Why rent control works

I shouldn’t even bother to talk about this, because all it will do is stir up the trolls, but I’m getting sick of all the talk about rent control being a source of San Francisco’s housing problem. The latest is an editorial in the Business Times, which I buy to read J.K. Dineen’s stories about commercial real-estate, among other things. I should treat it like the Wall Street Journal; nobody takes the Journal’s editorial page seriously.

But the BT is just putting in print the argument that I’m hearing from the neo-libertarians who seem to be more and more populous in this town. And it goes like this:

Rent control distorts the market, which should be controlled by supply and demand. When you have rent control, evil tenants can stay in one place a really long time, thus “reducing urban vitality by discouraging mobility.” They can save their money for something other than rent. And it’s deeply unfair to landlords, because, as the BT notes:

By artificially limiting the return a building’s owner can generate on his investment, it discourages him from spending to maintain or upgrade the city’s housing stock. Rent increases are ordained not by supply and demand but by the city’s rent board. Legally, controlled rents can only go up each year by a fraction of the inflation rate. The ability to recoup costs of improvement or maintenance are also tightly curtailed. Costs are subject to no such limitations, so generally as a rent-controlled landlord, the longer you do it, the further behind you get.

Actually, rents go up by the percentage of the inflation rate that’s due to housing. The ability to recoup maintenance costs are not “tightly curtailed.” But more important, this notion that landlords “get further behind” because they can’t raise the rent assumes that most landlords — and their bankers — are idiots.

When you buy a piece of rental property, you typically have to prove to the bank that the rental income from the place is adequate to cover the mortgage, the taxes, the insurance, and upkeep, the same way a person buying a home has to prove that he or she has adequate income to pay the costs. When banks make loans the borrowers can’t repay, you get the mortgage crisis we’ve seen — but most of those units were single-family homes.

If I buy a rental property, the rent that’s coming in TODAY is matched with the price I’m paying TODAY. If the rents are too low to cover the cost, I have no business buying the place. And the bank has no business loaning me the money.

In San Francisco, unless you’re a complete moron, you buy rental property knowing, as the banker does, exactly what the current tenants are paying, and understanding, as the banker does, that the law won’t let me raise those rents by more than a modest amount each year. You’re making a profit at those rent levels; if not, you shouldn’t buy the place.

Now: Under Prop. 13, your property taxes can’t go up by much more than the rent goes up each year. And if you aren’t a speculative gambler (if you are, you have no rights anyway), you almost certainly have a fixed-rate mortgage. So your biggest “costs” are just as constrained as the rents you get. Meanwhile, your property continues to appreciate in value as the tenants pay your mortgage and taxes.

I know a lot of landlords in San Francisco, and the honest ones all say that owning rental property is a great deal — for the owner. There are probably some poor landlords who either (a) made bad business decisions or (b) were subject to some awful disaster and now find themselves unable to make ends meet. But they are not common.

Here’s the bottom line: Rent control prevents landlords from making speculative profits when the housing market booms. It also allows non-wealthy people to live here, for long periods of time, and become part of the San Francisco community. Housing stability INCREASES “urban vitality.” That’s the point.

Real, effective rent control would include limits on rent increases when a property becomes vacant. Berkeley had that in the 1980s. It didn’t cause urban blight or landlords abandoning buildings; instead, it helped create the Gourmet Ghetto and a thriving local business scene because tenants had more money to spend. It was a great success, until the state outlawed it.

Oh, and don’t tell me it discourages new construction: All new construction, since 1979, is exempt from rent control in San Francisco.

Rent control is, I will admit, bad for people who see housing as a speculative commodity, to be traded with little regard for its function as a basic human right. But I see housing more as a regulated utility — private owners have the right to a regular, acceptable return on investment, but not to excessive profits. Tenants have the right to live in the same place their entire lives, as long as they pay the (stable) rent and don’t become a nuisance.

These are good things for a city. The only problem with San Francisco rent control is that it isn’t strong enough.

Attack me, trolls. Or better, make a civil counter-argument that doesn’t start with “The problem with Tim is ….” Cuz we all know about my problems.

 

 

Hey, you! “Tech people” are not the douchebags you think we are

I hear a lot of talk, especially from my own queer community, about how “tech people” are ruining San Francisco. From skyrocketing rent prices and disappearing diversity to economic and cultural ruination, the tech community has become the scapegoat for a lot of the problems we are facing in the city as a whole. As a tech worker, I’m writing this to say: wake up and direct your anger at the real sources of these problems.

First of all, let’s get one thing straight. The vast majority of “tech people” in San Francisco don’t make nearly as much money as you think they do. We are not making six-figure salaries, we are not personally driving up rent costs, and we are not killing the cultural community here. Simply put, we are trying to further our careers and make the city we call home a nicer place to live. 

From day one of living in San Francisco, I’ve put blood sweat and tears into building the cultural community in SF (music, mostly), and I’ll never stop doing that. I first moved here with my husband in 2006 from Indiana. We fell deeply in love with the city while visiting several times early on in our relationship, and knew this was where we wanted to call home. Of course queer acceptance came into play, but I loved the fact that the city had a life of its own, an entity with which I felt a kinship. I immediately immersed myself in the music scene here, forming a touring band and quickly becoming a booker and promoter for live shows. It wasn’t until several years into my time here that I snuck my way into the tech industry. Thankfully all those hours spent in my parent’s basement as a child on the computer helped! Here I am, five years into my tenure at Bay Area music tech startup Thrillcall, hustling every day to help build music communities not only in SF, but across the country.

I bust my ass doing this for modest pay just to get ahead and know I’m working in a field (music) that I love. I know many others like myself who have day jobs in the tech community that do the same.

However, accusations that I’ve been hearing lately would have you believe otherwise. Claims that “people like us” are ruining San Francisco by gentrifying everything and pushing out what San Francisco truly is. Protip: the Bay Area has, for quite some time now, been a hub for technology. This is not a new thing. Stop acting like it is. Directing anger towards us for what you consider woes to the community at large here is way off base. Bubbles have happened constantly since the early 1990s (or hey, 1840s), and anyone who has lived here for long can tell you this is true. 

The tipping point for me, to be honest, was the nonsense of people beating up a “Google Bus” piñata in the Mission, shouting epithets about how they’re the bane of San Francisco. The people that ride those buses are not to blame. They are not heading up that company, they don’t make millions of dollars, and they certainly don’t deserve the hatred being directed at them by many people here in San Francisco.

They’re utilizing a method of mass transportation (cutting down on carbon footprint) provided by their employer. If you want to be angry about something, be angry at the company, not the people who work for it. If you want to actually do something about it (beating a piñata in a public place solves nothing), then take your grievances to the heads of the companies you think are responsible for the predicament that San Francisco currently finds herself in.

You know what is ruining San Francisco? Complacency. Apathy. Misguided hate. Inaction. Put some energy into making change, not senseless whining.

If you’re upset about rising rent costs, be angry at the money-hungry landlords that do absolutely nothing to put money back into the city or help build culture. Want SF prices to stop skyrocketing? Let’s organize and drive proposals with our city government. Upset about the recent sanitization of many of the lovely traditions and values of San Francisco? Get mad at a-holes like Scott Weiner, who is actually supported by a lot of longtime, non-tech residents. Want more culture, arts, music? Maybe try reaching out to people that can help in the tech world instead of complaining about everything going downhill. 

A vast majority of the tech workers here in SF are upwardly mobile, culturally involved people. We are not ruining this city. We live here for much more than just the jobs we have. We love it, and it’s where we call home. We have as much control over the cost of living here as everybody else. And we are not the companies we work for, however large or small. Corporations, for the most part, suck. We all know that. Demonizing the people that work for them (while contributing to this wonderful city) is baseless, classless, and makes you look like a total dick.

We’re not the douchebags you think we are. Let’s put our energy toward doing good, instead of just pointing fingers. A great deal can be accomplished if people took an active role toward coexisting, rather than shouting “ENEMY!” to anyone who will listen. 

 

A call to arms

OPINION No one can deny that the San Francisco of the new dot-com boom is a scary place to live. Rents are astronomical: $2,353 is the median rent for a one-bedroom in the Bayview, an area that has never had high rents. Ellis Act evictions are up 68 percent from last year, and buyouts and threats of Ellis (de facto evictions) are skyrocketing. Longterm rent-controlled tenants live in absolute dread that their buildings will be sold to a real-estate speculator who will decide, a month later, to “go out of the business of being a landlord.”

Neighborhoods are being transformed, and not for the better. The once immigrant Latino and working-class lesbian area of Valencia Street is now mostly white, straight and solidly upscale. The Castro has more baby strollers per square foot than a suburban mall, not to mention a high rate of evictions of people with AIDS. Along Third Street and in SOMA and other areas, people of color are being pushed out, and the working-class is being replaced by middle-income condo owners. The African American population of the city is down to 6 percent.

Small businesses, too, are being decimated, as landlords demand higher and higher rents and chain stores try and creep into every block. If the demographics of the city continue to change and become more moderate, many longstanding political gains could be lost.

Resistance is not futile.

During the Great Depression, the Communist Party in the Bronx and elsewhere successfully mobilized the working class to block doorways when the marshals arrived to evict tenants. In the 1970s here in San Francisco, the “redevelopment” of the Fillmore and the I-Hotel was met with widespread protests. Then-sheriff Richard Hongisto went to jail rather than evict the working-class Filipino tenants at the I-Hotel. In the late 1990s, organizing to fight the evictions and displacement happening in the wake of the first dot-com boom culminated in a progressive takeover of the Board of Supervisors.

These days, there’s no mass movement to fight the evictions and displacement. Occupy Bernal, ACCE and others have successfully stopped the auctions of foreclosed homes, and even twisted the arms of banks to renegotiate some mortgages. Tenant organizations have been holding back efforts to weaken rent control for years.

Where is the building-by-building organizing of renters? Where is the street outreach in every neighborhood? Where are the blocked doorways of those being forced out of their apartments by pure greed? Where are the direct actions against the speculators and investors who are turning our neighborhoods into a monopoly game? Where is the pressure on the Board of Supervisors to pass legislation to curb speculation and gentrification rather than approve tax breaks for dot-com companies? Where is the pressure on state legislators to repeal the Ellis Act and other state laws that prohibit our city from strengthening rent control and eviction protections?

Every moment we wait, more people are displaced from their homes, more neighborhoods become upscale, more small businesses are lost. Progressives wake up.

It’s time to take back what’s left of our city.

A win for the tenants

EDITORIAL In a stunning victory, tenant advocates have managed to derail a terrible piece of condo-conversion legislation — and replace it with a compromise that actually improves the current situation and could help slow the wave of speculative evictions.

The supervisors need to support the revised version of the bill — and if Mayor Lee wants to have any credibility at all with tenants, he needs to sign it.

For some 30 years, San Francisco has had a strict policy limiting the conversion of rental apartments to condominiums. Only 200 units a year get permission, through a lottery.

But thanks to the popularity of tenancies in common (a backdoor way around the limit) and the state’s Ellis Act, which allows landlords to evict all their tenants and sell the units as TICs, there’s now a long waiting list.

TIC owners say it’s unfair that they have to accept (somewhat) higher mortgage payments and reduced value on their homes because the wait for a conversion permit has grown to ten years or more. Real-estate speculators see huge profits in clearing buildings of long-term tenants with rent-controlled apartments and selling the places as TICs.

When Supervisors Scott Wiener and Mark Farrell first proposed allowing more than 2,000 tenancy-in-common units to bypass the lottery, tenant advocates began organizing to defeat the bill. Nobody thought a compromise was possible — particularly when the landlord-backed Plan C refused to negotiate in good faith and look for a solution everyone could accept.

But with the help of Supervisors Norman Yee, Jane Kim, and David Chiu, the tenants were able to craft a deal that clears up the backlog — and then prevents any further conversions for at least a decade. That’s fair: If the limit is 200 a year, and TIC owners want to clear up a backlog of 2,000 all at once, a ten-year moratorium makes sense. The tenant package also bars conversion of any buildings with more the five units and includes more protections for existing tenants.

If this proposal is really about helping TIC owners who face a long and uncertain time on the conversion list, then the compromise ought to be fine — and indeed, many TIC owners support it. The real-estate speculators who want to see evictions continue at a rapid pace hate it — this would make TICs less appealing and less valuable. But that’s fine: Buying a TIC has never been, and should never be, based on a future promise of condo conversion. And if this slows down the horrifying epidemic of evictions and displacement, it will be a very positive change.

Wiener and Farrell didn’t accept the compromise, but it was amended into their legislation anyway. The new version will come before the supervisors May 7. The supervisors should see this for what it is — greedy speculators against everyone else — and vote yes.

STREET SEEN “My customers are Latin,” says the owner of Latin Bridal Silvia Ferrusquia, entertaining a crowd of mamas, grandmas, and our photographer while we wait for the models for our photoshoot to get their hair and makeup done, and don the massive, fairytale quinceañera dresses and tiaras they bought from her shop for their big days.

“They may not have a lot of money, but they have good taste. There’s nobody that serves this community the way we do.”

Sadly, the community may have to look for other options. After a decade in the Mission Street storefront, Ferrusquia — whose crowded, colorful shop is one of the last of its kind in the neighborhood — has been served an eviction notice.

In the spring of 2012, in the middle of the shop’s busy season, a damaged sewage pipe caused 11 ceiling tiles to fall, ruining close to a hundred of Ferrusquia’s ornate bridal, communion, and quince dresses with foul liquid. She says a representative from Prado Group, her landlord, told her to hold her rent payments until damage could be assessed and reparations made.

“What are we going to do without you?” customer Veronica Ortiz wonders, when she hears of the shop’s predicament. Ortiz was picking up her daughter’s communion dress, with its skirt of carefully-curled tulle roses. Like her sisters and sisters-in-law, Ortiz also bought her wedding dress from Latin Bridal. An extravagant gown inspired by Princess Diana’s famous nuptials, it had 6,000 crystals sewn to it, and a 20-meter train that Ortiz says was mistaken by guests at her hometown wedding in Durango, Mexico for the church aisle’s carpet as she said her vows.

Things went further south for the shop when the Prado representative with which they were communicating was fired. Ferrusquia was told by the company that she had to pay up the three months’ back rent in short order. After the losses sustained while her shop was smattered with sewage, mildew, and subsequent discovery of asbestos during its busy months, she was forced to file for bankruptcy.

After multiple warnings to pay the back rent (which has ballooned to a figure over $25,000 — a number representing six months’ rent that Ferrusquia does not understand and went unexplained by the Prado Group, who declined to comment when contacted for this feature), she was served with a final eviction notice this month. She tells me the building’s other tenants are being pushed out, that the Prado Group would only renew the shoe store next door’s commercial lease for a year and a half, and that she worries for the residential tenants upstairs.

The shop may be gone by the time you read this, if small business advocates are unable to help. At the very least we will have these photos of young customers in the Latin Bridal dresses they wore on the heretofore most important day of their lives — proof positive of Latin Bridal’s importance in a neighborhood that seems to have decided to change. “At least we’ll have gone out big,” says Ferrusquia’s son Eddie, thanking the shoot crew after the lights and curling irons are packed out.

“Don’t worry about anything on your day,” Ferrusquia says in Spanish to one of our customer-models, for whom the shoot is a test drive for her quinceañera next week. “Don’t let anyone rush you! This day will never happen again.”

You want to see something frightening on a lovely afternoon? Check out this amazing interactive map of Ellis Act evictions in San Francisco put together by Brian Whitty.

It’s stunning: Between 1997 and 2013, it seems as if most of the Mission, Noe Valley, North Beach, the Marina, and Potrero Hill was evicted. Hundreds and hundreds of apartments turned into TICs, which now want to convert to condos. Hundreds and hundreds of tenants, who once had rent-controlled apartments, losing their homes — and given the price of housing, losing their ability to live in San Francisco.

Each little red flag is a human tragedy. Each one represents a transforming city that no longer has room for the middle class, much less poor people. It makes we want to cry. Or throw up. Or something.

Boom life: Mattilda Bernstein Sycamore talks about ‘The End of San Francisco’

A picture of Brian Goggin’s iconic site-specific sculpture “Defenestration” (that 16-year-old “furniture leaping out of an abandoned building” piece in SoMa that may be demolished soon) is pictured on the cover of Mattilda Bernstein Sycamore’s latest book, The End of San Francisco — which I reviewed in this week’s Guardian.

It’s an almost too-perfect image to represent the book’s contents — “Defenestration” cheekily channeled the out-the-window frustration of the dawning of the first Internet boom, with its hordes of tech gold-rushers pushing out old San Francisco culture. (And now, in the middle of another tech boom, the artwork itself will be pushed aside to make way for affordable housing — the term for anything under $2500 per month rent pretty much at this point.) The End of San Francisco takes us on an atmospheric, highly personal through the turbulent period of the ’90s and early 2000s, while asking some hard questions about the queer activism, participatory gentrification, and “alternative culture” of the period. Along the way, Mattilda intimately delves into issues like her recovered memories of sexual abuse as a child at the hands of her father; the rampant drug use, mental illness, and hostile attitudes of Mission queer culture; the gynophobia and transphobia of many “underground” scenes, and much, much more. 

I asked Mattilda a few questions over email in advance of her appearances here at City Lights (April 30) and the GLBT Historical Society (May 9) to help set her book in the context of what was happening then, and what’s still happening now. As always, she pulled no punches.

SFBG What was the impetus for writing such a wide-ranging memoir? You cover almost your entire life, from some of your earliest memories to when you officially moved away from San Francisco. Was there a specific purpose when you sat down to write it?

MATTILDA BERNSTEIN SYCAMORE
With my anthologies, I always have a specific purpose in mind, a political intervention, but for this kind of personal writing – I write to stay alive. So it’s a different kind of intervention. I started with 1200 pages of material, and then separated different sections into themes. So, for example, the chapter called “The Texture of the Air,” originally that was something like 200 pages of writing about cruising and its limitations, about trying to regain a sense of hope in my own sexuality. Now it’s 15 pages. At some point I realized that the book centered around the myths and realities of San Francisco as a refuge for radical queer visions in community building. I first moved to San Francisco in 1992, when I was 19, and it’s where I figured out how to challenge the violence of the world around me, how to embrace outsider visions of queer splendor, how to create love and lust and intimacy and accountability on my own terms. I left San Francisco in 2010, and in some ways this book is an attempt to figure out why or how this city has such a hold on me, in spite of the failure of so many of my dreams, over and over and over again.

SFBG I think the most fascinating parts of the End of San Francisco are your spot-on description of life here in the 1990s, and your detailing of the excruciating decline of that era in the dot-com boom. Now
that we’re undergoing another dot-com boom, what are some of your thoughts as to how that’s once again affecting “alternative culture.” Is there any such thing as “alternative culture” anymore?

MBS Oh, it’s so sad! The way gentrification has progressed over these last 20 years. The displacement, the homogenization, the transformation of cultures of resistance into commodities. The way all of this limits people’s imaginations. At the same time, I don’t want to romanticize the past. In the early-‘90s, it felt like everywhere people were dying of AIDS and drug addiction and suicide; it was a desperate time, even if in some ways there were more possibilities for choosing a life outside status quo normalcy. But, no matter when we are living in this country so responsible for genocide, endless war, the destruction of the environment, we are living in a desperate time and we still need to come up with radical alternatives to giving up.

SFBG I figure a lot of the people who were here in that era (me included) will recognize a lot of truth in what you describe, including some pretty scathing but deadly accurate words about the people who thought they were on the forefront of alternative culture back then — how a lot of it was “vintage store glamour” and the “strung-out junkie look.” Have you had any reactions from anyone about that? Or from any of the people who were close to you back then that you’ve written about?

MBS I offered the manuscript ahead of time to everyone in the book who plays a major role. A few people didn’t respond. Some offered detailed feedback. And some, of course, are featured in conversations about the book, in the book – while The End of San Francisco is about my memories, of course these memories exist in the context of the relationships I’m describing. I want to challenge the notion of one true story, while at the same time I obsess about figuring out all these formative moments for me – politically, socially, sexually, ethically, emotionally. One of the funniest responses was from the first person who I trusted, we moved to San Francisco together in 1992. She wanted me to take out the parts where we do drugs, so she could show her kids!

SFBG Another fascinating part is your account of the rise and peter-out of Gay Shame [the guerilla anti-assimilationist co-founded by Mattilda]. You’ve talked about this before in previous books, like the anthology That’s Revolting — how did you approach writing about it within the context of this memoir?

MBS This writing is more self-critical. It’s more about the relationships I formed through activism, the gaps between our rhetoric of inclusiveness and the more complicated realities. Ultimately I’m looking at this activist group that meant so much to me, that challenged and inspired me in so many ways, but ultimately failed me. I’m not saying that it failed, but it did fail me and I’m trying to figure out why.

SFBG Do you think there’s any space now, in SF or anywhere else, for a true queer resistance movement?

MBS
There never is space. We have to create it. There is so much self-congratulatory rhetoric in San Francisco, especially in radical-identified queer spaces, and we’re never going to get to something beyond a cooler marketing niche unless we can examine the ways that so often in radical queer spaces people treat one another just as horribly as in dominant straight culture or mainstream gay culture, and it hurts so much more when this kind of viciousness comes from people you actually believe in.

SFBG I loved your take on the Eagle even while I disagreed with some of it. Have you been following the whole return of the Eagle thing, spearheaded by probably our loudest current voice in queer anti-assimilationism, Glendon Anna Conda Hyde?

MBS In the book, mostly I’m talking about how the Eagle, a bar entrenched in mainstream gay norms of mandatory masculinity, objectification without appreciation, racial exclusion, and fear of all things feminine without beards, became a hipster hotspot without changing its core values. I can’t comment specifically on Glendon Anna Conda Hyde, but I will say that it depresses me when people embrace tragic gay institutions as “community,” as if they have ever offered us anything meaningful beyond a place to get smashed with people we’ll hate in the morning. Yes, it’s also depressing that public sex cultures that used to exist South of Market have basically disappeared, but I think we need to envision new possibilities instead of fetishizing the past.

SFBG You write so boldly and candidly about sexual abuse, drug will addiction, illness, relationships, politics … were there any memoir models you worked off of, and were there any rituals you went through to be able to open up so much?

MBS I think most memoirs take the most fascinating, multifaceted, complicated lives and turn them into Choose Your Own Adventure books without the choice. I wanted to create something more layered and honest — I was drawn to exploring the places where my analysis stops, to using those gaps as openings into something more spontaneous and incisive. As a teenager I needed to create a facade of invulnerability in order to survive, in order to find other kids like myself, in order to go on living. But now that façade leaves me feeling shut off rather than connected. Now I’m drawn towards expressing vulnerability, I think that’s what will save me.

SFBG
I felt like you left us with a cliffhanger in terms of your father reconciling with you over memories of your childhood sexual abuse. Was there ever any resolution?

MBS
I love that it felt like a cliffhanger for you even though the part about visiting my father before he died was right at the beginning. That was an incredibly intense moment for me, to visit him on his deathbed, to go to the house where I grew up with all that violence and still be able to express everything, to sob and tell him that I loved him, something I would never have imagined I would even want to say, but it’s what I felt in the moment and so I figured why not, he’ll be dead soon and I don’t want to hold anything in. For me that felt really powerful: it meant that all this work I’d done to become someone other than the person my parents wanted me to be, it really had worked. That was a certain kind of closure, that openness. But no, he refused to acknowledge anything. He wouldn’t even tell me that he loved me.

SFBG In terms of queer relationships and friendships, The End of San Francisco speaks insightfully about pain, desire, co-dependence, processing, betrayal, apathy, need, and abuse. Was there ever any love? Could there be?

MBS Yes, there was so much love – I hope that comes through in the book! And nothing has let me down more than love.

A small but enthusiastic crowd marched through the Castro April 20 to bring some attention to the rash of Ellis Act evictions that are forcing seniors and disabled people out of the city. The activists stopped at the home of Jeremy Mykaels, whose plight is symbolic of the state of housing in San Francisco today. Mykaels insists he’s not a public speaker, but his remarks were poignant; we’ve excerpted them here:

I have AIDS and I am being evicted through the use of the Ellis Act. I want to welcome you to my home for the past 18 years, and to my Castro neighborhood where I’ve spent the last four decades, or two-thirds of my life.

I was there at some of the earliest Gay Pride Parades and Castro Street Fairs, listening to speakers like Harvey Milk and seeing entertainers like Sylvester with Two Tons ‘O Fun and Patrick Cowley. I proudly voted for Harvey to become the city’s first openly gay supervisor. I participated in the fight against the Briggs amendment, which would have outlawed gay teachers in California schools. I walked in the candlelight march honoring the lives of Harvey Milk and Mayor Moscone after their assassinations by Supervisor Dan White. And I’ve been here for many other protests and for many other celebrations.

And like most of you, I’ve seen how HIV and AIDS have devastated this community over the years and I have lost most of my closest friends and lovers to this disease. Until 12 years ago I thought I had somehow miraculously escaped it’s clutches, but that was not to be and I have been dealing with that reality as best as I can ever since, with mixed results. And now on top of the great losses this disease has cost our gay community, even more losses are occurring in the form of more and more long-term tenants with HIV/AIDS living in rent-controlled apartments being forced to move out of their homes and/or out of the city after being evicted through the use of the Ellis Act, or who have been scared and bullied by just the threat of an Ellis eviction into accepting low buyout offers to vacate.

I had always thought that I would spend the rest of my life living in this neighborhood and city that I love. Now I know that, like so many others before me who found themselves in similar situations, I will have no choice but to move out.

Tech boom 2.0 has brought out what I call the Vultures of Greed, a de facto alliance of banks, the real estate lobby, and, whether unwittingly or not, city officials like the mayor and several supervisors and the Planning Commission. But the worst Vultures of Greed have been the real estate speculators, many of whom I have listed on my website.

And here I would like to call out my own personal vultures as a prime example of how uncaring real estate speculators can be. The new owners of this property are Cuong Mai, William H. Young and John H. Du, and their business entity is 460Noe Group LLC, based in Union City. These are truly callous individuals who knew from the very beginning that they had a person with AIDS living in the building, and soon after they bought the place they began threatening me with an Ellis eviction if I didn’t accept their low-ball buyout offer and vacate. On September 10th, 2012 they subsequently Ellised the building and served me with eviction papers which means that I will only have until September 10th of this year to legally occupy my apartment. All these men want is the highest profit they can get after they remodel and re-sell this building. They could care less what happens to me when I am forced to move out of the city and no longer have access to all my HIV specialists who have kept me alive for this long. A prospect I’ll admit that, yes, scares me. But these guys, they won’t lose even a seconds sleep over my fate.


Yes, the Vultures of Greed are soaring high with sharpened talons ready to feed upon our city’s seniors and disabled, and on what’s left of our already decimated San Francisco gay community. But we don’t have to allow it. Together with our growing number of allies, we can change minds and we can eventually reclaim this city from the Vultures of Greed.

BTW, we couldn’t reach Mai, Young, or Du, and their lawyer, Saul Ferster, did not return a call seeking comment.

Screening is believing

SFIFF Most contemporary Americans don’t know much about Uganda — that is, beyond Forest Whitaker’s Oscar-winning performance as Idi Amin in 2006’s The Last King of Scotland. Though that film took some liberties with the truth, it did effectively convey the grotesque terrors of the dictator’s 1970s reign. (Those with deeper curiosities should check out Barbet Schroeder’s 1974 documentary General Idi Amin Dada: A Self Portrait.) But even decades post-Amin, the East African nation has somehow retained its horrific human-rights record. For example: what extremist force was behind the country’s Anti-Homosexuality Bill, which proposed the death penalty as punishment for gayness?

The answer might surprise you, or not. As the gripping, fury-fomenting doc God Loves Uganda reveals, America’s own Christian Right has been exporting hate under the guise of missionary work for some time. Taking advantage of Uganda’s social fragility — by building schools and medical clinics, passing out food, etc. — evangelical mega churches, particularly the Kansas City, Mo.-based, breakfast-invoking International House of Prayer, have converted large swaths of the population to their ultra-conservative beliefs.

Filmmaker Roger Ross Williams, an Oscar winner for 2010 short Music by Prudence, follows naive “prayer warriors” as they journey to Uganda for the first time; his apparent all-access relationship with the group shows that they aren’t outwardly evil people — but neither do they comprehend the very real consequences of their actions. His other sources, including two Ugandan clergymen who’ve seen their country change for the worse and an LGBT activist who lives every day in peril, offer a more harrowing perspective. Evocative and disturbing, God Loves Uganda seems likely to earn Williams more Oscar attention.

More outrage awaits in Fatal Assistance, Port-au-Prince native Raoul Peck’s searing investigation into the bungling of post-earthquake humanitarian efforts in Haiti. So many good intentions, so many dollars donated, so many token celebrities (Bill Clinton, Sean Penn) involved — and yet millions of Haitians remain homeless, living in “temporary” shelters. Disorganization among the overabundance of well-meaning NGOs that rushed to help is one cause; there’s also the matter of nobody trusting the Haitian government to make its own financial decisions. Peck, a former Minister of Culture, offers a rare insider’s perspective. Though the film’s voice-overs (framed as letters that begin “dear friend”) can get a little treacly, the raw evidence Peck collects of “the disaster of the community not being able to respond to the disaster” is powerful stuff.

There’s more levity sprinkled amid the tragedy (and bureaucratic frustration) contained in Ilian Metev’s Sofia’s Last Ambulance. If nothing else, this doc will make you extremely cautious if you ever find yourself visiting the capital of Bulgaria; its depiction of the city’s medical care is grim at best. An underpaid, harried trio — doctor, nurse, and driver — grapple with dispatchers who don’t pick up and drivers who don’t let ambulances pass, bad directions, outdated equipment, and other unbelievable situations that would be funny if lives weren’t hanging in the balance. Metev never films the patients, instead keeping his focus on the paramedics. Sarcastic nurse Mila Mikhailova is a standout, sweetly calming down an injured child, bluntly advising a drug addict, and joking about her love life with her co-workers. Only during rare moments of downtime does her exhaustion emerge.

More lives in chaos — albeit slightly more existentially — are depicted in A River Changes Course, which picked up a Grand Jury Prize for World Cinema Documentary at the 2013 Sundance Film Festival. Cambodian American filmmaker Kalyanee Mam followed a trio of rural Cambodian families over several years, eventually crafting a vividly-shot, meditative look at lives being forced to modernize. Talk about frustrating: farmers grapple with a new worry — debt — so the eldest daughter heads to Phnom Penh to work in a factory. But the paltry wages she earns aren’t enough to offset the money they will have to spend on food, since they can’t farm enough to eat without her around to help. Elsewhere, a teenage boy who figured he’d grow up to be a fisherman takes a backbreaking planting job when the fish grow scarce; he confesses to Mam that he’s long since given up any dreams of getting an education. “Progress” has rarely felt so bleak.

Adding a much-needed dose of quirk to all of the above is Kaspar Astrup Schröder’s Rent a Family Inc., about Ryuichi, a Tokyo man whose business name translates to “I want to cheer you up.” He’s a professional stand-in, offering himself or any of his rotating cast of staffers to pretend to be friends or relatives in situations, including weddings, where the real thing is either not available or won’t suffice.

That premise alone would make for an intriguing doc — though there’s a disclaimer that certain scenes with clients are “reconstructed” — but Ryuichi’s career choice feels even more surreal once it’s revealed how dysfunctional his own family is; among a wife and two kids, he gets along best with the family Chihuahua. Though Schröder focuses on Ryuichi’s ennui at the expense of delving into, say, what it is about Japanese culture that enables the need for fake family members, the guy is undeniably fascinating. “I’m like a handyman, fixing people’s social engagements,” he explains — but he has no clue how to mend his own. *

It’s between the airport and the ballpark in Oakland: the Dry Ice Arena, home of the immediate Bay Area’s thrivingest inline roller hockey scene. There’s a parking lot in back, and a store where you can get you your gear: skates, shirts, helmets. They rent these, too.

Against the windowless outside wall of the building, as you walk along looking for a door, you will find an occasional walk-in rat trap, badly parked cars, and a plastic bag full of crackers, which I wanted very badly to stomp on but didn’t.

Inside, Giant Robot was squaring off with the first-place Gentlemen’s Club in the Sunday Silver League B2 semifinals. The Gentlemen’s Club, top seed going in, had beaten Giant Robot during the regular season. That’s all I knew.

It’s five on five — a goalie, two up, two back — and they have a rule that any player can only score three goals. Which rule came in handy for the Gentlemen’s Club, or they might have lost even worse than 12-3.

Giant Robot team captain Len Amaral, who missed the whole first period on account of Giants’ game traffic, said he didn’t feel comfortable with their lead until near the end of the game.

“They can score in a hurry,” he said. “They’re a fast, good team.”

When he saw 4-1 on the scoreboard coming into the arena, he said, he thought at first his team was losing.

Nah. It was never in doubt. Thanks to some great goalie work by LeMarr Mojica, who had about a gazillion saves, Giant Robot never let the Gentlemen’s Club feel anything other than frustrated.

They extended their lead to 5-1 early in the second period, and by the end of the period it was 8-3.

A nice thing about roller hockey: since it’s not on ice, the puck moves a little slower, or seems to at any rate, and is easier to follow.

Another nice thing: no fights.

Seriously, I don’t believe I’ve watched a whole hockey game since the USA vs. Russia in the 1980 Olympics. And one reason pro hockey has eluded me, fandomwise, is the fighting. Not that I’m a pacifist; it’s not even that I’m a “good sport.” It’s that most of the time, under all that armor, you can’t tell who’s winning.

I’ll have my boxing in a ring, thanks. Without shirts, when possible.

Amateur hockey, though. Roller hockey . . . fun to watch!

We decided to stay for the championship game, but were too hungry to sit through the other semi-final, which would determine Giant Robot’s opponent in the finals.

Dry Ice Arena has a snack bar, but all they have is frozen fried things and candy bars. In retrospect I wish we had stayed put, because the takeout Indian we scored down on International was even inedibler than chicken nuggets.

We should have known. There was a calendar on the wall next to the refrigerator of this joint (which shall remain nameless), and it was still set to March.

“I hope they pay better attention to expiration dates than they do calendar ones,” Hedgehog observed.

“Don’t worry,” I said. I’d seen him take our food out. Of the freezer. It wasn’t going to make us sick. It just wasn’t going to taste any good.

Plus we had to wait forever for it, so we missed the most exciting game of the tournament. Empty Net and Apuckalips went down to the wire, swapping goals in the closing minutes, and Empty Net won by one to advance.

Problem: they didn’t have any subs.

Roller hockey, like the icier kind, is an incredibly strenuous sport. They sub often, when they have them. And Empty Net went into the championship already exhausted.

Giant Robot scored first, and fast. Their initial goal came 14 seconds in, and that was all they’d need. For good measure, they added six more.

Final score: Giant Robot 7, Empty Net 0.

I was them, I’d give the game puck to Mojica. Not only did he pitch a shutout in the Championship game, but he’d skunked the Gentlemen’s Club the final period of the first game. Remember? That’s four straight scoreless quarters! For rec-league hockey, I think, that’s pretty impressive.

An art benefit — for the artists

All sorts of political campaigns and causes raise money by asking artists to donate work that can be auctioned off. It’s not often that the artists themselves get the benefits.

So Matt Gonzalez — former supervisor, longtime criminal defense lawyer, and big fan of local arts — is putting together a different type of fund-raiser. It’s an art auction — to benefit the artists.

“This is a kind of thank you to the artists who have donated works in the past,” Gonzalez told me. “All the sale proceeds, every cent, goes directly to the artists. “As a result most artists are starting the bidding on their pieces at 1/3 or 1/2 of the retail price (since there’s no gallery cut to worry about).”

Gonzalez, along with co-sponsors Peter Kirkeby and Aimee Friberg, have paid to rent out Incline Gallery. Beer and wine will be served, cheap. Proposal would halt condo conversions for ten years

San Francisco Supervisors Norman Yee, Jane Kim and Board President David Chiu gathered with a cluster of tenant advocates at City Hall April 15 to unveil a proposal billed as a more equitable alternative to a highly controversial condominium conversion legislation that’s fueled a months-long battle over affordable housing.

Crafted with the input of tenant advocates, the new plan seeks to amend controversial legislation proposed earlier this year by Sups. Scott Wiener and Mark Farrell to allow a backlog of approximately 2,000 housing units to convert immediately from jointly held tenancies-in-common (TICs) to condos.

The proposal would effectively shut down the city’s condo conversion lottery for a minimum of 10 years, a measure aimed toward ending the cycle of real estate speculation that tenant advocates say has given rise to a spike in evictions in San Francisco’s supercharged housing market.

The proposal would still allow a current backlog of TICs to convert to condos without having to wait in a lottery system created to limit the number of units lost from the city’s rental housing stock. The board’s Land Use and Economic Development Committee, which is currently in session, will take up the legislation and proposed amendments later this afternoon.

The 10-year suspension on condo conversions would allow time for permanently affordable units to be built in place of the rental units that would be lost in the one-time conversion, proponents of the alternative legislation said. “If more affordable housing isn’t produced, then units don’t get to convert,” Housing Rights Committee executive director Sara Shortt told the Guardian. 

Chiu stressed that the proposal was crafted to “ensure that as we expedite condo conversions … we protect tenants by suspending the lottery for at least 10 years.”

The 10-year minimum suspension is based on current regulations capping condo conversions at 200 per year. It would last a decade because an estimated 2,000 units would be converted, but could last longer than that.

“For example, if 2,200 units are converted,” Chiu explained, “the suspension would last for 11 years.”

Meanwhile, the proposal would require the conversions that would be intially allowed to be staggered over the course of three years.

The plan “puts the Board of Supervisors on record that we strongly believe in preserving our affordable housing stock,” said Sup. Yee, adding that the package of amendments seeks to “address the risk of speculation that will ensue with a large number of TICs being converted to condominiums.”

The Wiener-Farrell proposal spurred a months-long opposition campaign led by tenant advocates, who said it would permanently remove affordable rental units from the city’s housing stock and incentivize evictions of long-term tenants at a time when Ellis Act evictions are already on the rise. 

“Condo conversions are the number one reason why people are being evicted from the city,” San Francisco Tenants Union executive director Ted Gullicksen said at the April 15 rally and press conference.

Wiener and Farrell’s proposal was presented as a way to remedy TIC owners’ complaints that onerous shared mortgages had left them financially strapped.

But Sup. David Campos, who also appeared at the rally, commented that the real challenge “is for the renters who are finding it very hard to live in San Francisco.”

Campos seemed dubious that a one-time condo conversion should be allowed to move forward at all. “If anything, I think we should be doing more to protect tenants,” he said. “My hope is … if it’s something we cannot live with as a community, we will make sure it dies,” he added, referring to the original condo conversion proposal. 

In an earlier attempt to strike a compromise between TIC owners and tenant advocates, “negotiations broke down quickly,” Shortt said in an interview. At the rally, she said this alternative was “drafted in a way that’s not trying to meet any political agendas.”

For many elderly and low-income tenants who have few options if they are faced with eviction, “there is no price tag that you can put on their units,” said Matt McFarland, a staff attorney at the Tenderloin Housing Clinic, who spoke at the rally. “Their most valuable possession is the long-term rent control on their property. For these tenants, it’s basically a death sentence when you get these eviction notices.”

What cabs really do

EDITORS NOTES There are two ways to look at the taxicab industry in San Francisco: Either it’s purely a business, out to serve customers with the products that are most profitable — or it’s part of the city’s public transportation infrastructure, and thus subject to regulations that ensure all parts of the city are properly served.

If you take the first approach, then you’re like the entrepreneurs who founded Lyft, Uber, Sidecar, and Tickengo. They offer a product that the market clearly wants — rides that can be summoned with a smart phone and tracked by geolocation (no more “when the hell is that cab going to get here?”), with both drivers and passengers rated on a Yelp-like system.

The newcomers have no interest in the city’s old-fashioned regulations, which really do, in some ways, date back to the days when cabs were buggies pulled by horses. They’ve got a business model, and they’re going to follow it.

The problem here is that cabs are not just a business. (Housing isn’t just a business, either; that’s why we have, for example, rent control, eviction protections, and code enforcement.) Taxis are an essential part of the transit system in San Francisco. They backfill where buses and trains can’t or don’t go. They provide a lifeline for disabled people and seniors who need a ride, for example, to and from health-care appointments or supermarkets.

They are absolutely essential to the tourist economy, which is the city’s biggest and most lucrative industry (tech is still far behind).

There are problems with this part of the transportation system, as there are problems with Muni and BART and airport shuttles. There need to be more cabs on the streets, particularly at busier times. The existing drivers and operators need better technology and a better dispatch system.

But taxi drivers — the old, traditional type — are required to pick up anyone and drive anywhere; they can’t cherry pick the most attractive rides. They have to go through screening and training that ensures the public is safe.

They are, like many other utilities, almost a part of the public sector. There’s a good reason for that. And it’s what the city and the state regulators should be looking at.

No progress in condo conversion standoff, despite the Chron’s spin

Perhaps it was just an unfunny April Fool’s Day joke or some wishful political spin, but the San Francisco Chronicle’s April 1 article about how tenancy-in-common owners and their political supporters are pushing legislation that would allow them to bypass the condo conversion lottery seriously misrepresented the city’s biggest current political standoff.

Nevermind the article’s over-the-top bias in favor of those poor, hard-luck TIC owners, like the featured Pacific Heights couple forced to raise their baby in a closet when all they really want to do is flip the apartment they bought for a profit. Or how the Chron all-but-ignored the fact that these TICs were rent-controlled apartments in a city where two-thirds of citizens rent. That kind of top-down view of the world is pretty typical for the Chron, even in its news stories, despite the paper’s strained claim to “objectivity.”

No, the article’s real sin was to get the basic facts wrong on where this political stalemate now stands, presenting the wishful spin of one side as if it were the latest news. Between the headline, “Owners seeking condo conversions may have shot” and the first deckhead, “Making progress” (which plays off this paragraph. “’I think we’re making progress in our discussions and negotiations,’ said [sponsoring Sup. Mark] Farrell, while noting the talks with tenant advocates, TIC owners, and real estate interests are ‘far from the finish line.’”) the article leaves the impression current negotiations may produce a compromise.

But the problem is that there aren’t any current negotiations between the two sides, and there haven’t been for weeks, according to tenant and other involved sources. In fact, they say there’s been no movement in this standoff since almost a month ago when I last reported that tenant groups and progressive supervisors were preparing a set of hostile amendments to the legislation.

They would allow a one-time condo lottery bypass for the nearly 2,500 TIC owners in the pipeline in exchange to shutting down the lottery for many years and preventing any conversions of rent-controlled apartments into condos until city builds a comparable amount of new affordable housing, and then probably restricting condo conversions to smaller buildings after that to protect large rent-controlled apartment buildings from real estate speculators.

That proposed compromise, which the article barely mentions before letting Farrell say “his legislation poses no threat to rent control,” would help the poor Pacific Heights couple at the center of the article. But the real estate industry and its conservative allies don’t really care about that couple as much as they do maintaining the flow of rental units into the real estate market, which is why the negotiations have broken down.

Instead, the Chron has Sup. London Breed – who is indeed a swing vote of the issue, but not one that tenant groups are counting on given how close she is to Plan C and the landlord lobby – citing a compromise proposal that would prevent the new condo owners from selling their properties for five years to discourage real estate speculation.

Perhaps that’s something the TIC owners and real estate interests that the article relies on think is a realistic compromise, but it’s not something that has been seriously discussed with tenant groups, mediating Sup. David Chiu, or the other interests that would be needed to pass this legislation.

Sara Shortt, the token tenant activist that the Chron talked to for the article, confirmed to us that there is no real compromise deal in the works and preventing the creation of new condos from existing apartments is a bottom-line issue that unites everyone who is now opposed to this legislation.

“The Plan C/Realtor etc. won’t concede on our key issue: restriction on future conversions in exchange for the bypass. We have given as much as we can give and they have given virtually nothing in return,” Shortt, executive director of the Housing Right Committee, told us by email.

Even Sup. Scott Wiener, who co-sponsors the legislation with Farrell, told us there has been “no change from before,” when negotiations broke down. But the legislation is on the April 15 agenda for the Land Use and Economic Development Committee – for the fifth time, with most hearings canceled because of the lack of negotiating progress.

If the Realtors and Plan C (which is dominated by real estate and banking interests) stick to their intransigent position – hurting this poor Pac Heights couple in the process, which the Chron fails to note – then tenants and progressive supervisors are likely to amend the legislation and call the bluff of those who claim this issue is simply about poor TIC owners stuck with shared mortgages.

In Rob Melrose’s new translation of Eugene Ionesco’s The Chairs, an elderly couple sit in the austere parlor of their lonely lighthouse, chortling over a spate of private wordplay and reminiscing of sprightlier times, until their initially frantic and disjointed dialogue settles into a smooth flow, well-polished by decades of endearments and gentle bickering. Possibly the last two survivors of a not entirely explained apocalypse, the isolated nonagenarians (magnificently played by David Sinaiko and Tamar Cohn) nevertheless make it known that important guests are expected to arrive at any moment in order to hear a hired orator (Derek Fischer) deliver the Old Man’s “message,” which he has spent a lifetime honing. As the doorbell begins to ring, a jarring squall, and invisible guests and dozens of mismatched chairs begin to crowd their peaceable empire in claustrophobia-inducing numbers, their companionable seclusion is shattered for good. Director Annie Elias manages to coax both gravitas and decorum out of this little-produced, yet influential absurdist relic, imbuing her protagonists with a depth of character that belies their farcical circumstances, while Theodore J.H. Hulsker’s murmuring sound design of crashing waves, angry winds, and the strident doorbell could almost be another character in the play, so thoroughly does it set the tone in ways that Ionesco might not have approved of, but is all the better for. As the centerpiece of its second annual festival of plays in honor of Women’s History Month, 3Girls Theatre, devoted to Bay Area women playwrights, revives Lynne Kaufman’s fitful but enjoyable 1985 dramatic comedy about the inception of the famous sexual and psychiatric triangle between Carl Jung (Peter Ruocco), wife Emma Jung (Courtney Walsh), and his mistress and analysand Toni Wolff (Maggie Mason). In this, her first play, Kaufman (whose most recent play, Acid Test, explores the life of Ram Dass) folds in Carl’s critical 1912 break with mentor Sigmund Freud (Louis Parnell) for an action-packed day Chez Jung. (Also on the scene is the Jung’s precocious daughter Katherine, played by a sure and animated Hattie Rose Allen Bellino). Amy Glazer directs a solid cast who convincingly blends the farcical aspects of the dialogue with its meatier and more dramatic ones, as new ties and power dynamics are sometimes roughly, other times genteelly negotiated. The former is usually the stuff of high comedy, as when Freud goes apoplectic upon learning Jung is not necessarily the disciple and “son” he had thought him to be. And Jung’s (proto-) New Agey leanings only add fuel to the fire: When Carl turns to the I Ching to decide on the best course of action for his career going forward, Freud erupts, “You idiot! You’re playing tiddlywinks with the human race!” But it is ultimately the politics of love and the household that take center stage, with Walsh’s vulnerable yet ever dignified Emma emerging as, if not the greatest psychiatrist, perhaps the greatest strategist of them all. The Resurrection of SHE Brava Theater Center, 2781 24th St, SF; www.brava.org. $20-30. Thu/4-Sat/6, 8pm; Sun/7, 3pm. San Francisco’s inimitable Rhodessa Jones is the beguiling heart of this musically transcendent and visually evocative performance-memoir, co-produced by Brava Theater and Cultural Odyssey. It’s a surefooted meander through a great swath of personal and historical experience led by an African American woman whose decades-long theater career has been the expression and instigation of many female “resurrections.” Backed by a multimedia collage designed by Stephanie Johnson and Pam Peniston, and accompanied onstage by excellent multi-instrumentalists and composers Idris Ackamoor (who also directed the show) and David Molina, Jones begins with a fraught poetical invocation of an African girl child roaming free on the deck of a slave ship. From there she delves into a by turns humorous, harrowing, and inspiring narrative rooted in her own Southern family history and the origins of what she calls her life-saving encounter with theater — one manifestation of which has been her powerful work with incarcerated women in the Medea Project. A recent iteration of the Project, in South Africa’s Naturena prison, forms the narrative anchor of the second act. A formidable performer and expert storyteller, Jones commands attention whether channeling specific characters, speaking impromptu to her audience, or erupting into song (in one a several canny musical numbers). In the process, she makes trivial the show’s few hiccups or loose ends with a sense of communion as impressive as her remarkable life. (Avila)

Sex and the City: LIVE! Rebel, 1760 Market, SF; trannyshack.com/sexandthecity. $25. Wed, 7 and 9pm. Open-ended. It seems a no-brainer. Not just the HBO series itself — that’s definitely missing some gray matter — but putting it onstage as a drag show. Mais naturellement! Why was Sex and the City not conceived of as a drag show in the first place? Making the sordid not exactly palatable but somehow, I don’t know, friendlier (and the canned a little cannier), Velvet Rage Productions mounts two verbatim episodes from the widely adored cable show, with Trannyshack’s Heklina in a smashing portrayal of SJP’s Carrie; D’Arcy Drollinger stealing much of the show as ever-randy Samantha (already more or less a gay man trapped in a woman’s body); Lady Bear as an endearingly out-to-lunch Miranda; and ever assured, quick-witted Trixxie Carr as pent-up Charlotte. There’s also a solid and enjoyable supporting cast courtesy of Cookie Dough, Jordan Wheeler, and Leigh Crow (as Mr. Big). That’s some heavyweight talent trodding the straining boards of bar Rebel’s tiny stage. The show’s still two-dimensional, even in 3D, but noticeably bigger than your 50″ plasma flat panel. (Avila)

Self-awareness, self-actualization, self-aggrandizement — for these things we turn to the professionals: the self-empowerment coaches, the self-help authors and motivational speakers. What’s the good of having a “self” unless someone shows you how to use it? Writer-performer Kurt Bodden’s Steve Seabrook wants to sell you on a better you, but his “Better Than You” weekend seminar (and tie-in book series, assorted CDs, and other paraphernalia) belies a certain divided loyalty in its own self-flattering title. The bitter fruit of the personal growth industry may sound overly ripe for the picking, but Bodden’s deftly executed “seminar” and its behind-the-scenes reveals, directed by Mark Kenward, explore the terrain with panache, cool wit, and shrewd characterization. As both writer and performer, Bodden keeps his Steve Seabrook just this side of overly sensational or maudlin, a believable figure, finally, whose all-too-ordinary life ends up something of a modest model of its own. In the second part, Shipwrecked, we find them older, perhaps wiser, struggling to keep their revolutionary ideals alive while also juggling familial concerns and personal passions. Focused mainly on Alexander Herzen (Patrick Kelley Jones) and family, Shipwrecked travels from Russia to Germany, France, Italy, and the English Channel, buffeted from all directions by the forces of the uprisings and burgeoning political consciousness of the European proletariat. It’s an unwieldy, sprawling world that Stoppard, and history, have built (made somewhat more so by the Shotgun production’s strangely languid pace during even the most dramatic sequences) but it’s worth making the effort to spend time absorbing the singular world views of Russian émigré Herzen, his impulsively passionate wife Natalie (Caitlyn Louchard), the cantankerous, influential critic Vissarion Belinsky (Nick Medina), professional rabble-rouser Michael Bakunin (Joseph Salazar) and up-and-coming writer Ivan Turgenev (Richard Reinholdt) as they desperately seek to carve out both their personal identities and a greater, cohesive Russian one from the imperfect turmoil of Western philosophy. Time to enforce the law

EDITORIAL The new tech companies that are making waves in San Francisco — Airbnb in the short-term rental business and Lyft and Uber in the taxi industry — may describe themselves as innovative and disruptive, and they may be appealing to investors.

But there’s a more accurate word that describes their relationship to the city:

Cheaters.

The way these companies are luring customers isn’t really about high-tech applications or brilliant business models. They’ve just found a way to get around the rules that everyone else has to obey.

Some city officials are talking about hearings and new legislation, all of which is fine. But in the rest of the business community, when someone flagrantly, openly violates the regulations, the City Attorney’s Office cracks down. That’s what needs to happen here, and soon.

Airbnb has a slick and appealing promise: You can rent out your house or apartment on the Internet to someone who wants to stay in the city for a few days, but is looking for an alternative to a traditional hotel. The homeowner or tenant gets some extra bucks; the visitor gets to stay in a cool neighborhood at a bargain price. What’s not to like?

Well, for one thing, most leases in San Francisco bar unauthorized sublets, so renters who offer their places on Airbnb face problems with their landlords, including possibly eviction. City laws also bar the use of residential property for commercial purposes. And, as we’ve pointed out repeatedly, Airbnb isn’t collecting the transient occupancy tax that every other hotel operator in the city has to pay. The total tab: At least $1.8 million a year.

Lyft and Uber say they’re using creative apps to offer an alternative to the screwed-up taxi system. Drivers offer rides to people who can “volunteer” to pay at the end — but if nobody pays, the whole business model fails and the venture capitalists who put up the money lose. So everyone knows that these are pay-for-hire taxis.

Except that San Francisco requires every taxi driver to have a permit, called a medallion — and drivers have to go through training, background checks, and carry extensive insurance. If a driver overcharges or refuses a fare, a customer can complain to the city, and get recourse. The startups don’t follow the same rules.

There are reasons the city regulates cabs and charges hotel taxes. Cab drivers are ferrying people, some of them vulnerable; it’s only a matter of time before a rogue driver who sneaks into the new unregulated startups winds up in a horrible crash or criminally preying on riders.

Driving a cab without a medallion is illegal. Failing to pay city taxes is, too. City Hall can debate and dither and try to avoid offending the mayor (who, unfortunately, is trying to help Airbnb slide). But this is a clear-cut case of businesses flouting city law. Herrera needs to put an end to it.

 

Reagan’s legacy: Homeless death

The headline on sfgate is about as brutal as you can get: “The coming homeless die-off.” But the brief story points to an alarming set of statistics: The median age of homeless people on the streets of US cities is now 53. The life expectancy for homeless people is 64. You get the point.

But here’s the key political element:

Social scientists say the median age has been steadily increasing for many years, supporting the “big bang” theory that many of today’s street people hit the gutter back in the 1980s era of recession and slashings of social programs.

Having lived through the Reagan Era, and worked with homeless people in the early 1980s at the Haight Ashbury Switchboard, I can tell you that makes perfect sense. Vast libraries of books have been written about the Reagan Era, but one of the things it represented was the end of major federal support for low-cost housing in cities — and the end of any concept of linking welfare payments to the cost of housing.

There were a lot of people living on General Assistance and SSI in San Francisco in the late 1970s, and most of them had homes. That’s because public assistance programs provided enough income to cover the rent on a cheap place. Between GA and food stamps, people who were, for whatever reason, unable to work wound up in crappy apartments and sometimes crappier SROs, but they weren’t on the streets.

Yes: Some of those people had serious substance-abuse issues. Yes: SSI and GA checks were going, in part, for drugs and booze. But even ignroing the notion that it’s much better for a drunk to have an SRO room than to be homeless, it’s also cheaper. San Francisco spends a fortune on homeless services, and if the feds (and the City and County) had indexed public assistance to the cost of housing (which happened pre-Reagan) the toll on the local taxpayers would almost certainly be lower.

So Reagan’s policies are now killing people on the streets of San Francisco. All these years later.

 

 

No golden years for LGBT seniors

According to studies, queer seniors are poorer than their straight counterparts. They’re half as likely to have health insurance, and two-thirds as likely to live alone. Not to mention facing discrimination in medical and social services, retirement homes, and nursing care facilities. So much for the “golden years.”
Here in San Francisco, LGBT seniors face another grave threat: evictions. Many of our elderly live in rent-controlled apartments that are targeted by real-estate speculators and investors out to make big bucks turning them into tenancies-in-common.

With median rents close to $3,000 a month and vacancy rates low, the odds are pretty good that an evicted senior won’t find an affordable place in the city. For a senior with AIDS, an eviction is especially threatening since our city offers the best treatment and services. Studies show that people with AIDS who lose their apartments tend to die sooner, especially if they become homeless. 

The only LGBT organization that actually addresses the housing needs of queer seniors is Open House. Its 110 units at 55 Laguna will be the first affordable queer senior housing development in the city. I hope it’s not the last. As for seniors with AIDS, there’s only one AIDS organization in the vast list of groups and services — the AIDS Housing Alliance — that actually finds housing for its clients. It was started by Brian Basinger, a gay man with AIDS, after he was evicted and his apartment was sold as a TIC.

No one knows how many LGBT seniors have been, and are being, evicted. Ditto for how many seniors with AIDS end up on the streets. We also don’t have stats on how many transgender seniors are victims of real estate greed or live in absolute terror of losing their homes. 

The Rent Board doesn’t break down its eviction stats by sexual orientation or even age. The city’s homeless count doesn’t mention if someone’s queer or transgender. There is no way to determine how many LGBT seniors live in SROs or with life-threatening conditions such as mold or lack of heat. Or how many live in homes that have been — or are being — foreclosed.

That’s why the housing subcommittee of the city’s LGBT Aging Policy Task Force is holding a hearing into the housing needs and concerns of queer seniors. Information is power.

All LGBT seniors — housed and homeless — are invited to come testify about their housing issues. Whether they live in an SRO or a home that they own, whether they sleep in a shelter or a rent-controlled apartment, whether they’re in a subsidized unit or an illegal in-law, the subcommittee wants to hear from them about their concerns and needs.

The subcommittee will ultimately be making recommendations that will be included in a task force report on what the city can do to address LGBT issues.
LGBT seniors deserve their golden years.

“It just gets different”: Ali Liebegott on her third book ‘Cha-Ching!’

When you’ve spent long, smelly months in a bus traveling the world sharing words with pockets of alternative community, the issue of place takes the fore. As she releases her third book Cha-Ching!, and as her decades-old Sister Spit collective embarks upon yet another tour of spoken word, queer revelry, and cramped living conditions, author Ali Liebegott is getting academic about it.

“I’m kind of obsessed with how artists can live,” she tells me in a SoMa coffeehouse. She had texted me for clarification the night before on whether it was okay to look “scummy” at our interview, but she looks pretty neat in her white tee, motorcycle helmet sitting next to her on a bench. “And how queer people can live. I always think, where would I live if I couldn’t live in San Francisco or New York?”

Liebegott teaches Sarah Schulman’s Gentrification of the Mind — a book that looks at how economic displacement changes our brain’s wiring — in her fiction class at Mills College. And in Cha-Ching!, the economy is an ever-present force, guiding protagonist Theo into shitty apartments in both NY and SF neighborhoods where there are few out gay people. (Not to mention a ludicrously depressing janitor job at a junk mail factory.) The book is Liebegott’s third after The Beautifully Worthless and The IHOP Papers

When I ask whether they’re getting easier to write as time goes on she just laughs. “If I had been a plumber, I’d be able to fix things in my sleep. It doesn’t get easier, it just gets different.”

In an ever-more-caffeinated manner, she and I discuss how those higher rents are coinciding with an era in which publishing houses are more hesitant about what they throw their weight behind. “[Queer literature] is the first to go,” Liebegott says. “All the queer books at Barnes and Noble are behind a potted plant, there’s like four of them, and one of those is Best Lesbian Erotica 1994.”

So it’s good that, as poor queers and creatives and poor creatives and queers get kicked out of their urban homes and prime shelf space, Sister Spit is on the rise. Once restricted to queer female writers, the tour now includes a variety of genders, and different kinds of artists.  

Liebegott’s book is one of the first to come out on the imprint that the group’s founder Michelle Tea was able to start through City Lights Books in the fall of 2012 — The Beautifully Worthless was also released through the imprint, as well as the amazing Sister Spit anthology from earlier this year. Tea’s fantastical young adult novel Mermaid in Chelsea Creek, set to drop this summer, is delicious. The collective’s gig at the main library on Sun/31 is in advance of yet another of its fabled tours. This time the path lies up and down the coasts, up to Canada, and into the Mid-West.

Along the way, the Sister Spit artists will meet audience members in places where there is no queer community, places where people fundraised to get them there. 

“I don’t want to say we’re a beacon of hope, but it is nice to give people this connection that they might not have,” Liebegott says. 

And that connection, more and more, may not be associated with any specific urban area. San Francisco, for example, would be beyond Liebegott’s reach as a home if it weren’t for her and her girlfriend’s rent control. “I kind of feel like we’re headed towards hell,” Liebegott muses, taking in our swank, caffeinated surroundings. “I feel like we’re already there.”

Regardless, art. Cha-Ching! deals in gambling addiction, drug addiction, poverty, ennui, animal abuse, powerlessness — but nonetheless, can be laugh out loud funny even, especially, when characters hit their low points.

She’s already planning her next book, about a war vet obsessed with feeding ducks. “I feel like I’m so mired in depressing things!” Liebegott says. “My threshold for that is much higher than most people.”

Cha-Ching!‘s ending, though, leaves room to hope that queers can triumph over today’s adversities. Or does it? At any rate, you have ample chances to buy the book at this week’s readings (Liebegott is one of the featured artists at the Sister Spit reading on Sun/31 as well.)

The right to transgender health care

OPINION When I first came out as a transgender man in the mid 1990s, I quickly realized that I would have to pay out-of-pocket for the health care I needed.

Nearly every insurance plan has outdated exclusions that bar transgender people from receiving medically necessary health care. Everything from cancer screenings to the care related to gender transition is commonly excluded, despite being provided without exclusion to non-transgender health insurance customers.

For working people everywhere, including members of the LGBT community, accessible, affordable, quality healthcare is critical. And for union members like myself, healthcare equity is part of a basic and broader vision for equality for all people.

In recognition of this vision, Pride at Work, the SEIU National Lavender Caucus, National Center for Transgender Equality, the Transgender Law Center, and Basic Rights Oregon have partnered for the very first Transgender Month of Action, aimed at lifting the healthcare inequities that face our community.

I began to gender transition in 1996, starting with hormone therapy, a process that required walking through countless hoops. I will forever be thankful to the Tom Wadell Clinic and Lyon Martin Clinic for making hormone therapy accessible to low-income and uninsured trans people like myself, but I know I was one of the lucky ones. A few years later, when I was insured, I began to feel as if insurance companies were the gatekeepers of my body.

I knew that I needed to get chest surgery and that it wouldn’t be covered by my insurance, so I held a rent party and told my friends and loved ones that I needed help. It took a lot of vulnerability to do that. Like everyone else, transgender people need acute care when they are sick and preventative care to keep us from becoming ill, including services that are traditionally considered to be gender specific — such as Pap smears, prostate exams, and mammograms.

But insurers frequently expand discriminatory exclusions in a way that denies transgender people coverage for basic services. Take the outrageous example of a transgender woman in New Jersey who was denied coverage for a mammogram on the basis that it fell under her plan’s sweeping exclusion for all treatments “related to changing sex.”

Sometimes, trans people are denied care completely. In the late 1990s, I went to a gynecologist, but the doctor refused to treat me. Over the next 10 years, likes so many other trans people, I did not get an exam, too embarrassed and outraged to seek treatment.

In 2001, I worked with the a group of transgender healthcare activists to remove discriminatory exclusions for trans employees. When the Board of Supervisors voted to remove these exclusions, it was a huge and historic victory. Since that decision over a decade ago, San Francisco has proudly provided inclusive health care to city employees — and there’s been no cost increase to the overall plan.

Pride at Work, the organization that brings together LGBT union members and their allies, has a sign in the office that states: An injury to one is an injury to all. That’s the premise that underscores the labor movement’s commitment to LGBT equality, including trans-inclusive healthcare.

And it’s why Pride at Work is organizing local and national efforts to educate LGBT people and labor unions about the importance of ensuring access to basic healthcare for transgender people and providing coverage of medically-necessary transition-related care in health insurance. This first-of-its-kind effort is inspired by the belief that all workers deserve to have all medically-necessary care covered by health insurance, including transgender people whose healthcare needs are not being met.
