Despite signs of economic recovery, many young people still face hard times due to high unemployment, low wages, and a lack of job opportunities. San Francisco Mayor Ed Lee recently sought to tackle this issue locally with the rollout of Summer Jobs + 2013, a public-private partnership with an ambitious goal of providing 6,000 jobs and paid internships for San Francisco’s young adults. It was the most ambitious goal ever pursued in a city jobs initiative, with particular emphasis on low-income youth.

“I’m calling on all San Francisco companies to take on this challenge to support the youth of San Francisco,” Mayor Lee said at a press conference in April, when he joined House Democratic Leader Nancy Pelosi in unveiling the program, the local manifestation of an Obama Administration jobs initiative. “Creating meaningful employment opportunities for our young people today will set them up for success now and in the future.”

But Summer Jobs + is falling far short of its goal, resulting in the creation of only 3,200 summer jobs. The Mayor’s Office is still holding out for a possible influx of hires next month that could bring it closer to the goal before summer’s end, Gloria Chan with the San Francisco Office of Economic and Workforce Development told us.

Last summer, the Mayor’s Office launched a similar initiative aimed at providing 5,000 youth jobs and internships, and ultimately exceeded the goal by 200 positions. Roughly 32 percent of those jobs were in the private sector, predominantly tech. At the end of the day, only about 14 percent of the program’s participants locked down private-sector jobs, with employers ranging from Starbucks to Bank of America to Twilio.

Despite some success in helping young San Franciscans find work, the efforts so far amount to a kind of Band-Aid solution to a problem that goes much deeper and cannot be solved by simply teaching young people to draft polished resumes. Youth unemployment, particularly among low-income and marginalized groups, has worsened over time and is linked to a broader trend of economic inequality.

The Urban Institute, a nonpartisan think tank, recently turned an eye toward economic pressures facing young people with the release of a study titled, “Lost Generations? Wealth Building among Young Americans.” (see “Wealth vs. work,” May 1).

The institute found that among young people, “Average wealth in 2010 was 7 percent below that of those in their 20s and 30s in 1983. Even before the Great Recession, young Americans were on a strikingly different trajectory. Now, stagnant wages, diminishing job opportunities, and lost home values may be merging to paint a vastly different future for Gen X and Gen Y. Despite their relative youth, they may not be able to make up the lost ground.”

In the aftermath of the Great Recession triggered by the economic crash of 2009, millennials ages 16 to 24 have faced dramatically lower employment and income rates in comparison with their elders, according to Bureau of Labor Statistics data.

In California, where unemployment stands at 10.5 percent, the millennial unemployment rate is 20.2 percent. Additionally, the median income of employed young adults in California fell from about $35,000 to $32,000 from 2005 to 2011, while other age groups recovered on average. In San Francisco, the unemployment rate for young people aged 16 to 24 was just shy of 14 percent in 2011, double that of individuals spanning ages 18 to 34.

“We know that there’s been a lot of reporting out there that the recession was particularly hard for young adults, but it’s also important to note that they are in a much bigger hole than everyone else,” Rory O’Sullivan, a policy director for Young Invincibles, told the Guardian.

Young Invincibles is a national organization that works to expand opportunities for young adults in education and employment, and to bring attention to the oft-ignored economic plight of young adults seeking a foothold in the job market.

Young Invincibles found the Great Recession hit young adults harder than any previous recession in recent history. A quarter of job loss experienced by millennials occurred after the recession ended, while the unemployment rate for 18 to 34 year olds has consistently been double that of those 35 and up.

“Young people usually take a big hit in a recession,” said O’Sullivan. “Since they’re often the first fired, last hired in a seniority system. You’re going to let go of recent hires and not the more experienced folks.”

It’s a problem that can potentially have broader effects in the long run. “There are huge consequences for the economy down the road if we have a whole generation out of work,” explained O’Sullivan. “Lack of internships and first jobs can really hurt a young person’s wages. If a young person graduates in a recession, their wages will take a hit for decades afterwards — and that could have huge consequences. We’re still a long way behind.”

There’s no easy fix for the myriad economic pressures surrounding young adults, but O’Sullivan points to public-private partnerships as a way to get young people back in the market, even though that doesn’t seem to be working in San Francisco. O’Sullivan said Young Invincibles would like to see more public service jobs created for young people. “There’s a huge demand,” O’Sullivan said. “Rebuilding after national disasters, building houses, tutoring. We have to do a better job of connecting young people to this workforce.”

City budget boosts homelessness spending, but not enough to meet demand

The city budget that is now awaiting approval by the Board of Supervisors includes new funding for individuals and families facing homelessness, but community advocates say it doesn’t devote enough of the city’s rebounding revenues to addressing this growing problem.

Last Thursday, the Board of Supervisor’s Budget and Finance Committee approved $2.4 million in “add-backs” to homeless services, on top of the $2.3 million that Mayor Ed Lee pledged to supplement the city’s initiatives to curb the burgeoning number of San Francisco’s individuals and families becoming homeless.

The committee’s proposed budget will go before the full Board of Supervisors’ for a vote this month, devoting at least $2 million for this fiscal year and $1 million the next in to continue the successful Homelessness Prevention and Rapid Re-housing (HPRP) program that provides eviction defense and rent and utility vouchers to residents at-risk of homelessness.

Other homelessness initiatives in the proposed budget include extending the Lower Haight First Friendship shelter for homeless families to a year-round schedule, permanent housing units at 5th and Harrison streets for transitional age youth, 33 Local Operating Subsidy Program (or LOSP) subsidies for low-income homeless individuals and families, and funding to construct 24 shelter beds for the City’s first LGBTQ-focused homeless shelter at Dolores Street Community Center.

But for many residents and families, these initiatives may not be enough to stay in their homes, or re-house themselves after becoming homeless. And as the rent prices continue to drastically rise in San Francisco as the city’s economy heats up, the search for affordable housing or shelter beds has become more and more desperate.

January’s point-in-time homeless count identified 6,436 homeless persons on the streets and in the shelters in the city, a majority of which became homeless as San Franciscans. The current number on the city’s wait list is 220 families with an expected wait of seven to eight months, according to the Human Services Agency, which runs the city’s homeless shelter system. This is slightly down from 268 families earlier this year, then the largest in city history.

As the Guardian reported recently, the number of eviction notices in San Francisco hit a 12-year high this year, indicating an increase in displacement that may compound the number of families on the emergency shelter waiting list.

Bevan Dufty, the mayor’s point person on homelessness, told the Guardian that “the city definitely is not seeking to expand the shelter system,” despite the near-record waiting list.

 “Yes, we have lost shelter beds in recent years, and the 24 we are adding at Dolores Street Community Services is a minimal number,” Dufty added. “But you have to have a toolbox to respond in different ways.” And Dufty claims that re-housing families through programs like HPRP services in the budget has been shown to be the best way to prevent homelessness.

In response, Jennifer Friedenbach of the Coalition on Homelessness told the Guardian that, although the $1 million of HPRP services did prevent 1,300 San Francisco households from becoming homeless last year, it only covered 15 percent of the city’s overall need based on the number of people seeking services through San Francisco’s Eviction Defense Collaborative.

When asked to respond to the Coalition’s estimate, Dufty replied that he could not comment on its accuracy, but he conceded that the HPRP funding is “certainly not going to satisfy all the need.”

Dufty stressed that the city has been able to reduce the number of homeless veterans and has responded to a noticeable outcry in the need for more transitional housing, especially from LGBTQ community activists. Although the version of the budget making it to the Board of Supervisor’s vote this month would not expand the homeless shelter system beyond the Dolores Street Community Services project, it would improve the city’s oft-criticized shelter reservation system for single adults.

Along with Dufty and the Mayor Lee’s support, Friedenbach advocated in the homeless community to change the current line-based system to a lotterized system run through the city’s 311 system.

“The current shelter waitlist system is really archaic,” Friedenbach told the Guardian. “People spend 17 hours a day trying to get a bed at night.” Mayor Lee proposed this change in his budget, especially so the indigent and elderly no longer have to stand for hours waiting in line for a bed.

Though Friedenbach acknowledges the positive in the budget initiatives, she pointed out that there is still only one shelter spot for every six homeless persons in San Francisco, and that she “doesn’t know what standard you can go by to say that is too much.”

The new revenue from November’s business tax reform measure, won through a ballot initiative pushed by on-the-ground community groups like the Coalition on Homelessness, should “go back to low-end communities who are hurt from years of reduced services in mental and public health,” Friedenbach said.

Last month, the Coalition on Homelessness and other advocates pushed the Budget and Finance Committee to double Mayor Lee’s proposed $1 million for HPRP for 2013-2014 and an additional 75 LOSP rental subsidies on top of the 25 the Mayor had already pledged. At its last meeting before the new fiscal year, the Budget and Finance Committee pledged an addition $1 million for HPRP, but only added eight new LOSP subsidies.

Friedenbach attributed the lower number to the city’s logistical problems of trying to find additional service providers for subsidies. The “add-backs” marked “a lot of progress for poor folks,” Friedenbach said, although the city will still have “a situation where a lot of money is coming in, but not trickling down.”

“San Francisco is at a critical juncture,” Friedenbach prefaced her public comment at a Budget and Finance hearing last month. “The influx of wealth is pushing the heart of the city—the working class and poor—out.”

The budget approved by the Budget and Finance Committee last Thursday will likely go to the full Board of Supervisors starting next week, July 9.

Community awaits benefits as Lennar finally breaks ground in Hunters Point

More than five years after San Francisco voters approved a massive redevelopment plan for the Hunters Point Shipyard and much the southeast part of the city — giving Lennar Corp., the country’s biggest home builder, the largest tracts of open land in the city — that project is now finally, slowly, getting underway.

But activists who have been following the project say the city is getting played by Lennar because of an agreement that lacks performance standards and has allowed the company to drag its feet to maximize its profits despite an affordable housing crisis in the city. And some community members say Lennar hasn’t lived up to promises of jobs and other benefits.

“The modus operandi of Lennar is bait and switch and delay,” Saul Bloom of Arc Ecology, who consulted on this development deal for the Redevelopment Agency before his contract was dropped in 2010 after publicly raising concerns, told us. Bloom and his firm have decades of experience analyzing complex development deals, and he has been tracking Lennar’s pattern of behavior around the country. 

Bloom said that when Lennar cut its initial deals with then-Mayor Willie Brown and other local officials in 1997, the company said it needed no external financing and that it would build housing affordable to Hunters Point residents, including rentals. Since then, the deal has gotten steadily better for the company and worse for San Francisco, and the groundbreaking date has been repeatedly pushed back.

“The city was not smart enough to build in liquidated damage and a performance schedule and that kind of thing,” Bloom said. “Lennar tells them what they want and the city tends to roll over, and there’s been no pushback.”

When Lennar ended up needing financing after all, the project stood by while a $1.7 billion deal with the China Development Bank Corp. was structured in 2012. Despite Mayor Lee personally participating in the quest for capital in China alongside the developer, the deal quickly collapsed. It is yet to be seen how Lennar will satisfy its commitments in the Bayview and at its separate Treasure Island site since the plug was pulled on the loan deal.

Lennar Urban Director of Community Affairs Cheryl Smith referred our questions to communications consultant David Satterfield of G.F. Bunting, who said that he passed them on to Lennar officials and, “They don’t have anything to say.” The Mayor’s Office also has not responded to our request for comment on the issues that Bloom is raising.

With a weak agreement and a lack of political will to push the company to expedite construction of affordable housing, Bloom said Lennar has simply waited for housing prices to increase and for other developers to lead the way in gentrifying Bayview Hunters Point before moving forward on the nearly 1,400 acres of land it controls in San Francisco — an area equivalent in size to the Presidio.

“Their incentive is to wait for the property values to rise…Lennar understands how much this land is worth,” Bloom said. “What Lennar has done is crafted a strategically smart box that the city is in.”

Yet after years of delays, the project did officially get underway last week (Wed/27), with a well-attended hilltop ceremony.  Mayor Ed Lee, former Mayor Willie Brown, District 10 Sup. Malia Cohen, and Cohen’s predecessor, Sophie Maxwell, joined Lennar Urban President Kofi Bonner to speak at the long-anticipated event.

Lennar’s local subsidiary, Lennar Urban, unveiled a master plan to convert the land to a brand new mixed-use community. At the ceremony, Brown remarked that “there is no other piece of soil that is as lucrative” as the Bayview Hunters Point peninsula and that it promises to be the “ideal place to live.”

The Hunters Point Shipyard, occupies roughly 500 acres of southeastern San Francisco and when taken together with neighboring Candlestick Point and parts of Bayview, it is the largest single tract of land in San Francisco designated for redevelopment. The other big redevelopment site in the city, Treasure Island, is also controlled by Lennar and its partners.

A former naval base, the shipyard was transferred to the city in 2004. Most naval operations there had ceased in 1974 and commercial uses declined in the 20 years that followed, steadily displacing black workers employed on the premises.

Affordable housing and job creation for neighborhood locals were two major stipulations in the ballot measure San Francisco voters approved in 2008. The “Bayview Jobs, Parks, and Housing Initiative,” however, entrusted that goal fulfillment almost wholly to Lennar and Bloom now questions whether that trust was well placed.

Phase 1 of the project will consist of construction of 1,400 new residential units in the shipyard, approximately 30 percent of which will one day be affordable housing. But Bloom said that Lennar has delayed construction of the affordable units until after much of the more lucrative market rate housing is done.

At the event, Bonner enthusiastically outlined the goal of having 800 of 1,100 market rate homes in this first phase constructed and occupied within 36 months time and Mayor Lee opened his remarks with the celebratory chant “Welcome to The Bayview! We need housing for everybody!”

But Bloom said that the city is rapidly gentrifying as Lennar waits to meet its affordable housing obligations, noting that the city was 11 percent African-American when Lennar cuts its first deal to develop Hunters Point in 1997, and that population is now 4 percent and falling.

Reconstruction of the Alice Griffith Public Housing Project will help Lennar to satisfy its affordable housing quota. Announcements of these plans garnered large applause from community activists in attendance, though they are slated for the project’s second phase, which likely won’t begin for years.

“They could build all of Alice Griffith on Parcel A, but they’re not going to do it,” Bloom said. “When is this community going to get what was promised to them?”

A group of picketers from Aboriginal Blackman United (ABU) was contained by SFPD at the bottom of the hill during the afternoon’s proceedings. As black town cars chauffeured officials to the event site, the protesters’ cries were drowned out by the music of Miles Davis playing from stage speakers.

ABU was protesting non-inclusive hiring practices at the shipyard site. Members, who were outnumbered by police 2-to-1, argued that they were being wrongfully barred access to the ceremony above and by the event’s conclusion, they had been relocated from the main intersection at Innes Avenue and Donahue Street to a side access road.

Job creation was trumpeted generally in the afternoon’s speeches, with Sup. Cohen applauding the public-private partnership between Lennar and Bayview organizations and Mayor Lee praising the project for “honoring labor and honoring local residents.” However, ABU’s founder and president, James Richards, said “we’re not getting the jobs or the contracts that the community people are supposed to get and that’s why we’re out here.”

Though ABU wants to see local residents of color placed in many of the new positions opening up, workers in the community have only been promised good faith consideration rather than actual job guarantees by the San Francisco Building and Construction Trades Council, which is in charge of staffing the project. Attempts to reach Michael Theriault, Secretary-General of the Council, were unsuccessful.

Bloom said Lennar has insulated itself from community criticism with an agreement that promises money to community groups that refrain from publicly criticizing Lennar or the project. He said Lennar has followed a similar pattern here as it has elsewhere, using its clout and political contacts to get lucrative redevelopment deals, then using delay and bait-and-switch tactics to make those projects more lucrative. He cited Lennar’s Mare Island project, which is now in bankruptcy, and its massive Newhall Ranch project north of Los Angeles.

In that latter deal, the California Public Employees’ Retirement System lost the $970 million it paid Lennar in 2007 for part of its stake in Newhall Land Development Co., which went bankrupt when the housing market crashed the next year. But Lennar built in an option to reclaim the shares, which a bankruptcy judge allowed Lennar to do in 2009 for just $138 million.

Bloom said that deal is typical behavior for a manipulative company that has a history of acting contrary to the public interest, but in which local political officials have given tremendous control over the city’s future.

“We remain skeptical about their commitment to getting it done,” Bloom said of the affordable housing that Lennar has promised. “What we’d like to see is some real action on the promises that were made to the public.”

Supreme Court same-sex marriage decisions: DOMA invalidated, Prop 8 case dismissed, SF reacts [UPDATED]

DOMA INVALIDATED

The Supreme Court released its ruling this morning that the Defense of Marriage Act, which denies federal recognition of same-sex marriage, “is unconstitutional as a deprivation of the equal liberty of persons that is protected by the Fifth Amendment.”

“DOMA singles out a class of persons deemed by a State entitled to recognition and protection to enhance their own liberty,” according to the majority opinion. “DOMA’s principal effect is to identify a subset of state sanctioned marriages and make them unequal.” The Court voted 5-4, with Justice Kennedy, who wrote the majority opinion, as the decisive vote along the usual liberal/conservative lines. This means that same-sex marriages performed in states that have legalized such marriages will be recognized by federal law.  

PROP 8 DISMISSED ON STANDING

As for Hollingsworth v. Perry, the Prop 8 case, it was dismissed on standing, due to the fact that the State of California refused to defend the case that would uphold Prop 8 (which denied same-sex marriage).That meant private citizens were left to defend a state statute, which was unprecedented, and the Court refused to rule on those grounds.

We have never before upheld the standing of a private party to defend the constitutionality of a state statute when state officials have chosen not to. We decline to do so for the first time here,” the majority Court statement (which broke along the typical 5-4 line) said. That means there is no specific decision from the Court regarding Prop 8, and the previous ruling, by Judge Vaughan Walker and upheld by the Ninth Circuit Court, that invalidated Prop 8 as discriminatory, stands.

This may mean that same-sex marriages in California can resume as early as July.

[UPDATE] REACTIONS AT CITY HALL

City Hall was totally packed at 7am when the US Supreme Court convened — tons of journalists, lots of couples, many signs in the crowd. Two screens were set up, one with a live blog from court chamber, the other with the CNN live feed. Huge cheers erupted at 7:11 when the decision was announced striking down DOMA and forcing the federal government to recognize the rights of same-sex married couples.  Then at 7:38, when the Prop 8 statement came down, the room went nuts. 

A moment later, an array of current and former city officials appeared at the top of the City Hall main staircase. Mayor Ed Lee and Lt. Gov. Gavin Newsom escorted a fragile Phyllis Lyon down the stairs — she, along with the late Del Martin, were the first same-sex couple to get legally married in California in 2004 — flanked by the rest of the city family, all with big smiles.

“Welcome to the people’s house of San Francisco,” Mayor Lee said, thanking the crowd “for sharing in this historic moment.”

“It feels good to have love triumph over ignorance,” he said.

At 7:44, City Attorney Dennis Herrera and Chief Deputy City Attorney Terry Stewart, who had been on the City Hall steps addressed reporters’ question on the legal details of the ruling, joined the crew to sustained applause as Lee recognized them. He then introduced Newsom, who in 2004 as San Francisco mayor allowed same-sex marriages to be performed, as “one person who used the power of this office to make history and show his love for the city.”

“San Francisco is not a city of dreamers, but a city of doers,” Newsom said. “Here we don’t just tolerate diversity, we celebrate our diversity.” He thanked Herrera and everyone who contributed to this moment. “It’s people with a true commitment to equality that brought us here.”

Newsom introduced Kate Kendall with the National Center for Lesbian Rights, who has led the coalition of groups that have push for marriage equality. She looked around the crowd and said, “Fuck you, Prop 8!”

The crowd roared, and she said that she had scanned the room for children, and promised to “put a dollar in the swear jar” if necessary. But she said that, “We have lived for too many years under that stigmatizing piece of crap.”

Then Herrera took the podium, turned to Newsom, and said, Now you can say, ‘Whether you like it or not!'” — a joking reference to Newsom’s same-sex marriage rallying cry, which some blamed for boosting the anti-same-sex marriage cause.

“We wouldn’t be here today if it wasn’t for Gavin Newsom’s leadership,” Herrera continued. ““I remember in 2004 when people were saying it was too fast, too soon, too much.”

But today, that long effort has been vindicated, Now, he said, “It’s about changing the hearts and minds of people and educating them.” He also pledged to continue the fight that began here in City Hall more than nine years ago: “We will not rest until we have marriage equality throughout this country.”

Finally Stewart, who has argued cases related to San Francisco’s stand before both the US and California Supreme Courts, praised both the Prop. 8 and DOMA rulings and the precedents they set. “In the DOMA case decision, the Supreme Court expressed a stong equal protection philosophy…that will help legalize same sex marriage in other states.”

Three members of the Board of Supervisors were also invited by Kendell to address the huge City Hall crowd: Board President David Chiu and Sups. David Campos and Scott Wiener, the only two current supervisors who are gay.

Chiu noted that the bust of slain Sup. Harvey Milk is prominently positioned outside the Board Chambers, a reminder of the long struggle for gay rights that San Franciscans have led. “That work lives on today,” he said.

He added the hope that the work done here will ripple out of across the country because, he said, “As goes San Francisco, so goes California, so goes the rest of the country.”

Campos, an attorney who has long been in a committed relationship, said, “It’s a very emotional moment for those of us who are part of the LGBT community.” He said this Supreme Court ruling is the first time it has really acknowledged “that we are people and we have dignity,” and that the rulings sends a clear message to Congress that legislation like DOMA is unconstitionally discriminatory.

Wiener praised the resilience of the LGBT community, from the early days of enduring the AIDS crisis and fighting for federal support through the current campaign for marriage equality. And he cheered the fact that, “Those marriages that we see under the rotunda [in City Hall] will get a little more diverse.”

11:30 AM UPDATE: Style and substance

While Newsom strutted around like a proud peacock in front of City Hall — clearly the leading man in this epic story with the happy ending, much in demand by the television crews — Herrera and Stewart briefed various reporters on the details of the case that they had just won.

“I wanted a merits ruling, but a standing ruling is a victory too,” Herrera told us, making the distinction between the court ruling that banning same-sex marriage is unconstitutional on the grounds of equal protection under the law — which it did not do — and the 5-4 ruling it did issue: that those who appealed the Ninth Circuit Court ruling invalidating Prop. 8 lack proper legal standing to do so.

The standing ruling leaves same-sex marriage opponents more wiggle room to argue that the ruling might only apply to the couples named in the suit, or in just the counties that took part, which also included Alameda and Los Angeles, positions they were already signaling in press statements.

But Herrera said that he would vigorously contest that kind of challenge, which he considers to be without merit, telling us, “The injunction is not limited in its scope.”

UPDATE: SFPD isn’t worried

Police Chief Greg Suhr, who attended the City Hall event, said the timing on the ruling during Pride Week couldn’t be better. “It’s nice that it all lined up for us,” he told us. “This town is going to rock ‘til the wheels come off.”

Asked whether he has any heightened security concerns about the Pride Parade in the wake of a ruling that is controversial to some, Suhr said that he’s not worried. He said SFPD is now fully staffed and all available personnel working this weekend, although he will try allow many of his gay and lesbian officers to join the celebration if they want.

“We’re going to police what’s likely to be the biggest party this city has ever seen,” Suhr said, adding that his policing philosophy is, “We plan for the worst and hope for the best.”

 

Tale of two cities

Interesting piece in the LA Times a few days ago, Our new mayor, Eric Garcetti, wants to bring raves back to Los Angeles. After the death of a 15 year old that snuck into the Electric Daisy Carnival event at the Coliseum, the raves have gone to Vegas, where they’re pulling in 100K in attendance. The mayor sees dollar signs in those numbers, not to mention OT for city employees that have been hurting the last five years from budget cuts. A sensible idea.

It got me to thinking, as these things do, about a more general policy of bringing lucrative businesses and events to LA. After all, downtown business rents are cheaper than New York or Tokyo and there is far more space here as well. The city’s soon to be highest high rise will be a Korean owned hotel, so LA has already demonstrated a cooperation with Asian interests that cannot be matched. Not by New York or any other American city, even those on the West Coast. Like Seattle, Portland or erm, San Francisco.

If Garcetti and the city council decided to offer up better deals for high-tech than exist 390 miles to the Northwest, there is precious little Mayor Lee could do to match. LA has a lot more money and of greater importance, much more space. 49 square miles cannot compete with 480 square miles. And with the Internet making high tech jobs doable anywhere, why wouldn’t tech start ups decide to opt for LA?

Let’s face it, San Francisco has priced itself right off the grid. For all of Mayor Lee’s tax incentives, the city is incredibly expensive to rent or buy in. It is still possible to find a decent 1 BR in Silver Lake or Eagle Rock or Highland Park for under 1200 a month–where is that in SF, Bayview (if at all)? And no 82K parking spaces or multi million dollar Manhattan sized condos either–for 3 million bucks, you can buy a reasonable property in the West Side’s swankest hoods–what does that get you in Pacific Heights?

LA is a very expensive city to live in by dint of car ownership as necessity and driving distances. It’s also nowhere near as pretty as San Francisco is. But as SF approaches Tokyo-like exclusivity, it would take very little to pry high tech firms south–where it’s always warm, the beaches and ski resorts both near and best of all–the entertainment business and its attendant pleasures and power are nearby. 

Let’s face it, SF has screwed up–their biggest business for eons is tourism and that would never change were the city not so insistant on wrecking same with crack downs on clubs and “1984”-like scare tactics. Los Angeles–with its money and power can offer incentives that Mr. Lee and his cromies could only dream of–and with a forward thinker like Garcetti at the wheel, this may be inevitable.

 

Everyone but Mayor Lee sees SF’s worsening “housing affordability crisis”

There was a clear theme that ran through yesterday’s Board of Supervisors meeting from beginning to end, something understood equally by renters, homeowners, and politicians from across the political spectrum: San Francisco has a crisis of housing affordability that is forcing people from the city.

And the only person who doesn’t seem to understand or care about that is the person with the most power to deal with the situation, Mayor Ed Lee, who opened the meeting by essentially dismissing both short- and long-term gentrification forces and claiming “our city has some of the toughest anti-displacement laws in the country.”

It was a claim that Lee made twice, first in response to a question by Sup. Eric Mar about Plan Bay Area and the massive displacement of current San Franciscans that it would create by 2040. And it was also how he answered a question by Sup. John Avalos about rents that are now skyrocketing beyond what most San Franciscans can afford.

I followed Mayor Lee back to his office, asking him to explain his claim, and he cited the city’s “elaborate” rent control laws and the Rent Board recently hiring new personnel as he briskly retreated toward his office. But surely he’s aware that displacement is already happening and getting worse, I told him, citing Rent Board figures showing that evictions are now at a 12-year high.

Lee looked at me dubiously and said, “I’ll have to check the figures on that.” I followed up today with Press Secretary Christine Falvey to ask whether Lee did check those figures — which show 1,757 evictions in the last year, up from 1,395 the previous, both numbers representing returns to the mass displacement of the last dot-com boom — and I’ll update this post if/when I hear back.

“It shows he’s out of touch with what’s happening in San Francisco,” Avalos told me in response to the mayor’s remarks.

Lee seemed to bristle at the suggestion that his aggressive economic development policies might have a downside that he’s going to have to deal with at some point. He touts the 44,000 jobs the city has added during his mayoral tenure, even deflecting criticism that he’s too focused on the technology industry by citing estimates that every tech job creates at least four other jobs (seemingly oblivious to the fact that most of these are low-wage service sector jobs, the very people who are being forced from the city).

“I’m just hoping you’re not blaming the 44,000 jobs we helped created,” Lee told Avalos, saying that he understands the concern about the rising cost of living, “but those are 44,000 people drawing a paycheck and taking care of their families.”

Yes, Mr. Mayor, but those paychecks are having an increasingly tough time paying for housing in San Francisco. That concern animated the condo conversion debate that took place later in the meeting, voiced by those focused on the lack of affordable homeownership opportunities and those focused on reducing the city’s rental stock to create those opportunities.

“I don’t think saying ‘it’s good that we have a growing economy’ is enough to address the issue,” Sup. David Campos said during the condo debate, referring to Lee’s earlier remarks.

Speaking near the end that discussion, Campos summarized the concerns expressed by both sides and sought to put the legislation into perspective: while important, the condo deal is a drop in the anti-displacement bucket. “We are only dealing with the issue of affordability in San Francisco on the margins,” he said, later adding, “I don’t think we’re doing enough to deal with the fundamental issue of who gets to live in San Francisco.”

The debate on the condo conversion began with its original author — Sup. Mark Farrell, who represents District 2, the wealthiest and most conservative in the city — explaining his desire to help middle class people who want to own homes remain in the San Francisco.

“This is the most affordable form of home ownership in San Francisco today,” Farrell said of tenancies-in-common, the fiscally and legally precarious middle step between an apartment and condominium. Later, he said, “We need more affordable homeownership opportunities and not less.”

Farrell argued that “this didn’t need to be a zero sum game,” but that’s exactly what the stock of rent-controlled apartments is in San Francisco, where only housing built before 1979 is protected from the market forces that can drive rents up to whatever a landlord demands.

“We have a fixed rent control stock. Every apartment that converts to a a condo is one less unit,” said Board President David Chiu, who worked with Sups. Jane Kim and Norman Yee and tenant group to amend Farrell’s legislation to help both renters and homeowners.  

“These units were once the homes of tenants who were displaced,” Kim said, objecting to the notion that one person’s apartment should be another person’s affordable homeownership opportunity and arguing that the city should be building more condos for first-time homebuyers instead of cannabalizing the homes of the nearly two-thirds of city residents who rent.

Like Chiu and Kim, Yee said that he wanted to help the TIC owners of today without simply clearing out of the backlog and letting the condo lottery continue unabated, which would green-light even more conversion of apartments. “We want to curb the speculation,” Yee said.

That idea that the city should help people who live in the city, without simply feeding the speculative investors who profiteer off of housing in San Francisco, was a strong theme among critics of condo conversion.

A pro-tenant crowd packed the Board Chambers. Although barred by board rules from addressing the condo legislation directly (that occurred at the committee level), one commenter said, “Giving any more power to the real estate market in San Francisco should be considered a crime.”

To help ward off real estate speculators once the annual condo conversion lottery resumes in 2024, the legisation also limited future conversions to buildings of less than four units, instead of the current cap of six units, a change that Farrell resisted.

“This is not an academic exercise anymore,” Farrell said of the condo conversion restrictions that were added to the legislation. “This will negatively impact thousands of TIC owners in the city.”

Farrell’s original co-sponsor, Sup. Scott Wiener, had a more pro-tenant point-of-view, objecting to the changes that Chiu inserted on more narrow grounds. In his comments, he noted how close the two sides were and how they share the same basic goal: preventing displacement of current city residents.  

“The one thing we can all agree with is we have a housing affordability crisis,” Wiener said, praising the city’s rent control and tenant protection laws, but adding, “TIC owners are also part of this city.”

The price of dealing with the rapid growth in the city — whether it comes to infrastructure or housing affordability — was also a point that Wiener made earlier in the meeting as the board approved the term sheet for a massive office and residential development project proposed at Pier 70.

“We are not doing what we need to do to support the public transportation needed for those projects,” Wiener said, also referring to other projects along the waterfront (the Warrior Arena at Pier 30 and the Giants/Anchor Steam project at Pier 46) and in the southeastern part of the city. “We don’t have the transit infrastructure to support our current population, let alone new growth.”

It’s about striking a balance, as Chiu said he did with the condo legislation, and not just a balance between renters and TIC owners. It’s about striking a balance between how to protect the San Francisco of today while planning for the San Francisco of tomorrow.

Yes, that means working with market rate housing developers, and it also means diverting some of their would-be profits into the city’s affordable housing fund and its infrastructure needs. Yes, it means private-sector job creation, but it also means more public sector jobs and providing a safety net for people without jobs or who work as artists or social workers or other professions that are being driven from the city. And it means beefing up our public housing and turning around the exodus of African-Americans, concerns raised at the meeting by Sup. Malia Cohen.

We at the Guardian last year looked at how Oakland has become cooler than San Francisco, largely because of the displacement from here. And now, even many people within the tech community have begun to decry the gentrifiction that is being driven by Mayor Lee’s narrow economic development vision.

“Plan Bay Area is an opportunity to think regionally and strategically about planned growth,” Lee said when addressing Mar’s question, sidestepping the direct answer that Mar sought on a set of specific proposals for mitigating some of the displacement planned for San Francisco and maintaining this city’s diversity.

Yes, we do have an opportunity to think strategically about the city we’re becoming and who gets to live in it, but only if we don’t think “jobs” is the answer to every question.

Thunder from West Portal: Quentin Kopp savages the Warriors’ Embarcadero Wall and its $220 million taxpayer subsidy

When then State Sen. Quentin Kopp was appointed to the bench in San Mateo County, some of his fellow judges took him out to lunch.  “We hope you realize you have now given up your First Amendment rights,” he was told.

Judge Kopp did as he was told and kept silent for years on the bench on the many issues he felt strongly about and would have taken on in the public arena.   Today, however, he is retired, given up judicial restraint, and is back in action exercising his First Amendment rights with gusto. Operating from a desk in the office of Atty. Peter Bagatelos in West Portal, Kopp blasted the scavengers on behalf of an initiative aimed at upending the scavenger monopoly and controlling rates (he was right.) He has fired away at the RosePak/Willie Brown/Chinatown power structure on the Central Freeway.
He regularly blasts Mayor Lee for “compliancy” on big development, District Attorney for any number of misdemeanors and indiscretions, and former Sup. Sean Elsbernd for being Sean Elsbernd.

Now, in the current edition of the Westside Observer, Kopp has hit his stride with an acidic but well argued column titled appropriately, “The Art of Picking the Public Purse.” 

His lead: “It’s all privately funded!  Those aren’t my words; those are the words of the billionaire owners of the San Francisco Warriors and compliant Mayor Edward Lee respecting the proposed (and financially complicated) Warriors proposal to build a mammoth sports and entertainment arena on San Francisco Piers 30-32.”

Kopp wryly urges his readers to forget that the proposed project, “with Lee as the spear carrier (proudly proclaiming that the wrongly placed arena would be his ‘legacy’) would, if ever built, be higher than the “hated Embarcadero Freeway, which many San Franciscans spent years detesting and attempting to eliminate.”

Instead, he said taxpayers should concentrate on the “taxpayer subsidy of up to $200,000 (including interest) to the Warriors.” And he lays out the arguments and stats that demolish the Warriors’ line that “it’s all privately funded.”  Warming up, Kopp writes that the Warriors demand that Piers 30-32 be fully reconstructed, at Port cost, to a standard that will support the immense 19,000-seat arena.  The reconstruction cost is an estimated $120,000,000. Every single penny of such $120,000,000 is public money, i.e. the Port. The Port must borrow the money to reconstruct those piers.

“From whom? The Warriors, of course, and for the privilege of borrowing such money (for the Warriors’ benefit), the Port will pay the Warriors an exorbitant 13% per year as interest.”

More: “the port must sell the Warriors an enormously valuable piece of public land across the Embarcadero (Seawall 330) for a highrise hotel, condominium and retail development (b3: gulp).” Still more: “under the proposed Warriors’ deal, the $120,000,000 borrowing would be approved by a simple majority of the Board of Supervisors. The San Francisco Giants in 1996 and the San Francisco 49ers in 1971 were not afraid to secure voter/taxpayers approval. Maybe Lee and the Warriors are afraid the truth is that $120,000,000 is needed for the extraordinary cost of bearing the proposed arena’s weight, and supporting facilities the Warriors want to build on a platform over San Francisco Bay (b3: gulp again.)” You get the idea. 

Kopp’s arguments cry for an independent analysis by Harvey Rose, the city’s respected  budget analysis, who did a prescient assessment of the costs of the America’s Cup project. Kopp’s columns, along  with the excellent reporting of Patrick Monette-Shaw on Laguna Honda and George Wooding on the Ethics Commission and others, demonstrate that the Westside Observer under Editor Doug Comstock and Publisher Mitch Bull has become a sharp critic of City Hall from a neighborhood point of view and the best neighborhood paper in town.

Supervisors approve condo legislation with veto-proof majority

The San Francisco Board of Supervisors today voted to approve compromise legislation that will allow more than 2,000 tenancy-in-common homeowners to convert to condominiums in exchange for a 10-year moratorium on the city’s current condo conversion lottery that now allows 200 conversions annually.

Approved by a veto-proof 8-3 majority after some last amendments were shot down by the six supervisors who most steadfastly supported the version that Board President David Chiu took the lead on crafting, this was a big victory for tenant groups who strongly opposed the original legislation, which did not include the moratorium and other restrictions.

“It’s great. We’re going to see a significant drop in condo conversions in the future. All of us tenants are very happy,” San Francisco Tenants Union head Ted Gullicksen told us after the hearing, which was packed with tenant supporters.

Sup. Mark Farrell, who sponsored the original legislation, decried how divisive the issue had become, criticized the approved version as deviating from his original intent of helping TIC owners in exchange for a fee that would help fund new affordable housing, and said, “This doesn’t need to be a zero sum game.”

But Chiu and the five supervisors who supported his version – Jane Kim, Norman Yee, David Campos John Avalos, and Eric Mar – noted the finite number of rent-controlled apartments in the city and the need to protect them from being converted into condos.

“How do we balance the needs of tenants who fear being evicted with TIC owners looking for relief?” Chiu said of the balance he aimed to strike, which he continued to tweak with new amendments today, including allowing TICs with all owner-occupied units to move forward if the legislation is challenged in court, an event that would otherwise freeze all condo conversions until the lawsuit is resolved.

Sup. London Breed wanted even greater flexibility in that so-called “poison pill” aspect of the legislation, which tenant groups had insisted on to prevent the bypass from going through even if the moratorium was challenged. Breed proposed allowing condo conversion applications to proceed for a year after a lawsuit was filed, but Chiu said that would let TIC owners convert to condos while challenging other aspects of the legislation, such as the lifetime leases for tenants in converted buildings.

Breed and Sup. Malia Cohen, who privately and rather grimly conferred with one another and sometimes Chiu before the item began a little after 4pm, were clearly the two swing votes on the question of whether the legislation would reach the crucial eight-vote threshold needed to override a possible mayoral veto. Mayor Ed Lee has refused to take a position on the issue, leaving both sides in the dark.

But after the motion to insert Breed’s amendments failed on a 5-6 vote, the board voted 8-3 to approve Chiu’s version of the legislation, with Sups. Farrell, Scott Wiener, and Katy Tang opposed. A subsequent vote on a version of the legislation backed by Farrell and Wiener – which contained a weaker poison pill and more flexible owner-occupancy provisions – then failed on a 4-7 vote, with Breed joining the three dissenting supervisors.

Underscoring this legislation was what some supervisors called a “housing affordability crisis” in San Francisco, an issue that Mayor Lee was asked about at the start of the meeting, which he deflected by claiming “our city has some of the toughest anti-displacement laws in the nation.”

We’ll analyze that discussion and offer more details on the condo conversion debate and the politics behind it tomorrow in the space, so check back then.      

Supervisors pose tough but important questions to Mayor Lee

There’s a full agenda at the San Francisco Board of Supervisors meeting today, from the condo conversion lottery bypass legislation to approval of the term sheet from the massive development project at Pier 70, but some of the most interesting and potentially newsworthy items are at the very beginning of the agenda, when Mayor Ed Lee will answer questions posed by the supervisors.

Unfortunately, if past is prologue, Lee won’t give direct, substantive answers to the vitally important questions that he’s being asked, just as he dodged a question on the condo conversion debate in February and has kept everyone in the dark of which of the rival measures he supports and which he may veto. Mayoral leadership was desperately needed on that protracted debate, just as it’s needed today on some of the questions he’s being asked.

The first question, posed by Sup. Eric Mar, concerns Plan Bay Area and how it plans to pack 280,000 more people into San Francisco by 2040, which was the subject of a May 28 Bay Guardian cover story and panel dicussion that we’re sponsoring at the LGBT Center tomorrow night.

Mar lays out the massive displacement of existing residents and the traffic gridlock that the plan will create in San Francisco and how the approval process from much of this streamlined development may be given waivers from California Environmental Quality Act review.

Mar notes more than 40 regional groups have come together to try to improve the plan and mitigate its damage, and he plans to ask Lee:

“A consensus has formed around the following recommendations for making Plan Bay Area better:

– Provide $3 billion in additional operating revenue for local transit service and commit to a long-range ‘Regional Transit Operating Program’ to boost transit operating subsidies by another $9 billion over the coming years.

– Move 5 percent of the housing growth from low-income communities (mainly San Francisco, Oakland, and San Jose) to transit-connected suburban job centers.

– Incorporate strong anti-displacement policies for community stabilization measures, such as land banking and preservation of affordable housing in at-risk neighborhoods.

– Director the Planning Department to analyze the impacts of potential CEQA streamling as soon as possible and create strong mitigation measures.

Do you support these measure, and are you committed to a plan with lower displacement level than the current proposal? If you do not support these ideas, why not?”

Excellent  question, and definitely an appropriate one for our chief executive officer, who would have more clout to push for these changes than any of the supervisors.

The second question comes from Board President David Chiu, who makes news by noting that Mayor Lee has continued his predecessor’s underhanded practice of refusing to fill city positions to provide services that the supervisors have decided to fund in the budget, undermining the city’s balance of power and Lee’s rhetoric on collaboration.

“In recent months, Controller data indicates that positions allocated by the Board for librarians, recreation and park staff, building inspection, health and labor enforcement, urban agriculture and other Board priorities were either not filled or only recently hired. Will you commit to ensuring that when the FY 13-14 budget is approved, our Board of Supervisors’ priorities are treated equally to your Administration’s, with positions filled as soon as possible?”

Again, great question about an important current issue, the kind of thing that voters created this question time for, to ensure that there was communication and collaboration between these two branches of government.

The last two questions concern San Francisco’s housing crisis. Sup. David Campos cites the scatching report that he commissioned from the Budget and Legislative Analyst on the dysfunctional and mordibund Housing Authority, which Lee controls, asking “what is your long term vision to save public housing — a significant public asset to San Francisco?”

Sup. John Avalos cites data on the skyrocketing rents in San Francisco and asks, “Are you concerned that your administration’s policies to stimulate economic activity, especially supporting the tech industry, have created one-sided development and only job for high-income ‘appsters,’ and have exacerbated the already extremely limited housing market? Do you have any plans to address the increasing rents, and increasing rate of evictions and displacement of long-time San Francisco renters?”

These are tough questions, but they are central to what kind of city San Francisco is becoming. They were all submitted last week, so the mayor has had time to think about them and he should provide answers and show leadership on these difficult issues. That is his job.

Rival condo conversion measures finally up for board vote

Controversial condominium conversion lottery bypass legislation is finally headed for a vote by the full Board of Supervisors this Tuesday. Befitting legislation that has stirred strong emotions and traveled a twisting political path over the last six months, there are new dramas and uncertainties cropping up at the last minute, including the lingering unknown of where Mayor Ed Lee stands.

Originally co-sponsored by Sups. Mark Farrell and Scott Wiener, the legislation was intended to allow 2,000-plus tenancy-in-common owners to buy their way past the city’s lottery that allows 200 conversions to condominiums each year. But tenant groups and their progressive allies strenuously opposed the idea, and it was amended by Sups. David Chiu, Jane Kim, and Norman Yee working with tenants to couple the bypass with a 10-year moratorium on new conversions, thus clearing the backlog without opening the door to speculators taking more rent-controlled apartments off the market.

The Land Use Committee voted June 3 (2-1, with Chiu and Kim voting yes and Wiener opposed) to send the tenant-supported legislation to the full board and keep a Wiener-backed rival measure stuck in committee. But since then, Wiener invoked a board rule allowing four supervisors to pull the stalled legislation out of committee, getting Farrell and Sups. Katy Teng and London Breed to place that rival measure on Tuesday’s agenda as well.

Tenant groups decried the move and have put out the call for supporters to flood City Hall for the 2pm meeting, but Wiener told us that the differences in the two pieces of legislation are minor. One difference deals with whether transfers of ownership interest will affect an applicant’s spot in the queue and the other involves the so-called poison pill inserted by tenant groups, which would freeze the conversion process if anyone challenges the legislation in court, as real estate interests have threatened to do.

Wiener said the tenant-backed legislation’s changes to condo conversion eligibility, such as a 10-year wait period and banning future conversions of buildings with more than five units, that would remain in place after a successful legal challenge is an unfair overreach. But Chiu said tenant groups have already compromised as much as they can and they need this protection: “This is a carefully constructed compromise, and for the first time tenants groups are supporting thousands of condo conversions.”

Breed’s concerns about the poison pill provision — which was why she said she went along with Wiener’s play to bring up the rival measure — go even beyond Wiener’s. While most concerns involved a lawsuit from real estate interests, Breed worries about a pro-tenant litigant who wants to stop all condo conversions.

“If anyone chose to sue, it would help renters by shutting down everything completely. Where is the incentive not to sue?” Breed told us, noting that she still doesn’t have a solution to the problem, but she wanted the leverage of rival measures in order to address the issue. “I’m hoping it’s a win-win for renters and TIC owners,” she said. “Everyone else is not my concern right now.”

But the real estate interests will almost certainly try to preserve an ability for speculators to continue funneling more rent-controlled apartments into the real estate market, and just yesterday, the San Francisco Association of Realtors announced the hiring of an influential new point person on lobbying and housing issues: Mary Jung, a former spokesperson for then-Mayor Gavin Newsom before moving over to represent PG&E, and who was last year elected chair of the Democratic County Central Committee.

That could make a difference when it comes to Mayor Lee, who has resisted efforts by both sides to weigh in on the issue, saying only that he supports both tenants and TIC owners and that he understands the concerns about opening the door to a flood of new conversion requests.

“The one wild card here is no one know where the mayor is,” Wiener told us, noting that neither side is likely to get the eight votes that would be needed to override a veto. “The mayor, if he wanted to, could have significant leverage in crafting a compromise.”
Chiu said that he’s confident that his version of the legislation has the six votes needed to pass, but that it is still unclear what Mayor Lee will support, despite Chiu asking Lee to weigh in publicly in February and privately during a meeting yesterday. As Chiu told us, “We’ll see.”

Randy Shaw just loves Capitalism

Well: We all know that Randy Shaw, director of the Tenderloin Housing Clinic and editor of BeyondChron, is a loyal, devoted fan of Mayor Ed Lee. We know that he pretty much sees no wrong in the Lee Administration. But his attack on the Chron’s John King for daring to say that there’s a lack of planning on the waterfront is remarkable not only because there IS a lack of planning on the waterfront but because Shaw’s position is essentially that King is (gasp) anti-Captialist.

Seriously:

Ultimately, King’s critique is more directed at the U.S. capitalist system than to Mayor Lee, his predecessors, or other urban mayors. Private developers have long called the shots in urban America because the government does not go into the lucrative business of building and operating office buildings, luxury housing or tourist hotels. In the absence of government development, private interests determine what gets built. And when planners decide, under King’s favored approach, to dictate land use policies for a certain area, success is dependent on attracting private investment.

 Randy: The whole concept of city planning is “dictating land use policies for a certain area.” That’s not just King’s favored approach; it’s the essence of how progressive cities operate. Yes, you (sadly) have to attract private investment, but you don’t have to let the private developers lead the way. You can say: This is the kind of city we want; if you want to build here, build to our terms.

If you don’t do that, you become the wild west.

I’m surprised how far Randy Shaw has moved to the right on development issues in the past year; this piece could have been written by the folks at SPUR. Everything is about serving the needs of the private sector.

So BeyondChron is now the voice of the developers, and the Chronicle is the one raising the critical issues. What an odd world this has become.

 

 

A win for the tenants

EDITORIAL In a stunning victory, tenant advocates have managed to derail a terrible piece of condo-conversion legislation — and replace it with a compromise that actually improves the current situation and could help slow the wave of speculative evictions.

The supervisors need to support the revised version of the bill — and if Mayor Lee wants to have any credibility at all with tenants, he needs to sign it.

For some 30 years, San Francisco has had a strict policy limiting the conversion of rental apartments to condominiums. Only 200 units a year get permission, through a lottery.

But thanks to the popularity of tenancies in common (a backdoor way around the limit) and the state’s Ellis Act, which allows landlords to evict all their tenants and sell the units as TICs, there’s now a long waiting list.

TIC owners say it’s unfair that they have to accept (somewhat) higher mortgage payments and reduced value on their homes because the wait for a conversion permit has grown to ten years or more. Real-estate speculators see huge profits in clearing buildings of long-term tenants with rent-controlled apartments and selling the places as TICs.

When Supervisors Scott Wiener and Mark Farrell first proposed allowing more than 2,000 tenancy-in-common units to bypass the lottery, tenant advocates began organizing to defeat the bill. Nobody thought a compromise was possible — particularly when the landlord-backed Plan C refused to negotiate in good faith and look for a solution everyone could accept.

But with the help of Supervisors Norman Yee, Jane Kim, and David Chiu, the tenants were able to craft a deal that clears up the backlog — and then prevents any further conversions for at least a decade. That’s fair: If the limit is 200 a year, and TIC owners want to clear up a backlog of 2,000 all at once, a ten-year moratorium makes sense. The tenant package also bars conversion of any buildings with more the five units and includes more protections for existing tenants.

If this proposal is really about helping TIC owners who face a long and uncertain time on the conversion list, then the compromise ought to be fine — and indeed, many TIC owners support it. The real-estate speculators who want to see evictions continue at a rapid pace hate it — this would make TICs less appealing and less valuable. But that’s fine: Buying a TIC has never been, and should never be, based on a future promise of condo conversion. And if this slows down the horrifying epidemic of evictions and displacement, it will be a very positive change.

Wiener and Farrell didn’t accept the compromise, but it was amended into their legislation anyway. The new version will come before the supervisors May 7. The supervisors should see this for what it is — greedy speculators against everyone else — and vote yes.

Indicator city

When biologists talk about the health of a fragile ecosystem, they often speak of an “indicator species.” That’s a critter — a fish, say, or a frog — whose health, or lack thereof, is a signal of the overall health of the system. These days, when environmentalists who think about politics as well as science look at San Francisco, they see an indicator city.

This progressive-minded place of great wealth, knowledge, and technological innovation — surrounded on three sides by steadily rising tides — could signal whether cities in the post-industrial world will meet the challenge of climate change and related problems, from loss of biodiversity to the need for sustainable energy sources.

A decade ago, San Francisco pioneered innovative waste reduction programs and set aggressive goals for reducing its planet-cooking carbon emissions. At that point, the city seemed prepared to make sacrifices and provide leadership in pursuit of sustainability.

Things changed dramatically when the recession hit and Mayor Ed Lee took office with the promise to focus almost exclusively on economic development and job creation. Today, even with the technology and office development sectors booming and employment rates among the lowest in California, the city hasn’t returned its focus to the environment.

In fact, with ambitious new efforts to intensify development along the waterfront and only lackluster support for the city’s plan to build renewable energy projects through the CleanPowerSF program, the Lee administration seems to be exacerbating the environmental challenge rather than addressing it.

According to conservative projections by the Bay Conservation and Development Commission, the Bay is expected to rise at least 16 inches by 2050 and 55 inches by the end of the century. BCDC maps show San Francisco International Airport and Mission Bay inundated, Treasure Island mostly underwater, and serious flooding the Financial District, the Marina, and Hunters Point.

Lee’s administration has commissioned a report showing a path to carbon reduction that involves promoting city-owned renewable energy facilities and radically reducing car trips — while the mayor seems content do the opposite.

It’s not an encouraging sign for Earth Day 2013.

 

HOW WE’RE DOING

Last year, the Department of the Environment hired McKinsey and Company to prepare a report titled “San Francisco’s Path to a Low-Carbon Economy.” It’s mostly finished — but you haven’t heard much about it. The department has been sitting on it for months.

Why? Some say it’s because most of the recommendations clash with the Lee administration’s priorities, although city officials say they’re just waiting while they get other reports out first. But the report notes the city is falling far short of its carbon reduction goals and “will therefore need to complement existing carbon abatement measures with a range of new and innovative approaches.”

Data presented in the report, a copy of which we’ve obtained from a confidential source, shows that building renewable energy projects through CleanPowerSF, making buildings more energy-efficient, and discouraging private automobile use through congestion pricing, variable-price parking, and building more bike lanes are the most effective tools for reducing carbon output.

But those are things that the mayor either opposes and has a poor record of supporting or putting into action. The easy, corporate-friendly things that Lee endorses, such as supporting more electric, biofuel, and hybrid vehicles, are among the least effective ways to reach the city’s goals, the report says.

“Private passenger vehicles account for two-fifths of San Francisco’s emissions. In the short term, demand-based pricing initiatives appear to be the biggest opportunity,” the report notes, adding a few lines later, “Providing alternate methods of transport, such as protected cycle lanes, can encourage them to consider alternatives to cars.”

Melanie Nutter, who heads the city’s Department of the Environment, admits that the transportation sector and expanding the city’s renewable energy portfolio through CleanPowerSF or some other program — both of which are crucial to reducing the city’s carbon footprint — are two important areas where the city needs to do a better job if it’s going to meet its environmental goals, including the target of cutting carbon emissions 40 percent from 1990 levels by the year 2025.

But Nutter said that solid waste reduction programs, green building standards, and the rise of the “shareable economy” — with Internet-based companies facilitating the sharing of cars, housing, and other products and services — help San Francisco show how environmentalism can co-exist with economic development.

“San Francisco is really focused on economic development and growth, but we’ve gone beyond the old edict that you can either be sustainable or have a thriving economy,” Nutter said.

Yet there’s sparse evidence to support that statement. There’s a two-year time lag in reporting the city’s carbon emissions, meaning we don’t have good indicators since Mayor Lee pumped up economic development with tax breaks and other city policies. For example, Nutter touted how there’s more green buildings, but she didn’t have data about whether that comes close to offsetting the sheer number of new energy-consuming buildings — not to mention the increase in automobile trips and other byproducts of a booming economy.

Tom Radulovich, executive director of Livable City and president of the BART board, told us that San Francisco seems to have been derailed by the last economic crisis, with economic insecurity and fear trumping environmental concerns.

“All our other values got tossed aside and it was all jobs, jobs, jobs. And then the crisis passed and the mantra of this [mayoral] administration is still jobs, jobs, jobs,” he said. “They put sustainability on hold until the economic crisis passed, and they still haven’t returned to sustainability.”

Radulovich reviewed the McKinsey report, which he considers well-done and worth heeding. He’s been asking the Department of the Environment for weeks why it hasn’t been released. Nutter told us her office just decided to hold the report until after its annual climate action strategy report is released during Earth Day event on April 24. And mayoral Press Secretary Christine Falvey told us, “There’s no hold up from the Mayor’s Office.”

Radulovich said the study highlights how much more the city should be doing. “It’s a good study, it asks all the right questions,” Radulovich said. “We’re paying lip service to these ideas, but we’re not getting any closer to sustainability.”

In fact, he said the promise that the city showed 10 years ago is gone. “Gavin [Newsom] wanted to be thought of as an environmentalist and a leader in sustainability, but I don’t think that’s important to Ed Lee,” Radulovich said.

Joshua Arce, who chairs the city’s Environmental Commission, agreed that there is a notable difference between Newsom, who regularly rolled out new environmental initiatives and goals, and Lee, who is still developing ways to promote environmentalism within his economic development push.

“Ed Lee doesn’t have traditional environmental background,” Arce said. “What is Mayor Lee’s definition of environmentalism? It’s something that creates jobs and is more embracing of economic development.”

Falvey cites the mayor’s recent move of $2 million into the GoSolar program, new electric vehicle charging stations in city garages, and his support for industries working on environmental solutions: “Mayor Lee’s CleantechSF initiative supports the growth of the already vibrant cleantech industry and cleantech jobs in San Francisco, and he has been proactive in reaching out to the City’s 211 companies that make up one of the largest and most concentrated cleantech clusters in the world.”

Yet many environmentalists say that simply waiting for corporations to save the planet won’t work, particularly given their history, profit motives, and the short term thinking of global capitalism.

“To put it bluntly, the Lee administration is bought and paid for by PG&E,” said Eric Brooks with Our City, which has worked for years to launch CleanPowerSF and ensure that it builds local renewable power capacity.

The opening of the McKinsey report makes it clear why the environmental policies of San Francisco and other big cities matter: “Around the globe, urban areas are becoming more crowded and consuming more resources per capita,” it states. “Cities are already responsible for roughly seventy percent of global carbon dioxide emissions, and as economic growth becomes more concentrated in urban centers, their total greenhouse gas emissions may double by 2050. As a result, tackling the problem of climate change will in large part depend on how we reduce the greenhouse gas emissions of cities.”

And San Francisco, it argues, is the perfect place to start: “The city now has the opportunity to crystallize and execute a bold, thoughtful strategy to attain new targets, continue to lead by example, and further national and global debates on climate change.”

The unwritten message: If we can’t do it here, maybe we can’t do it anywhere.

 

ON THE EDGE

San Francisco’s waterfront is where economic pressures meet environmental challenges. As the city seeks to continue with aggressive growth and developments efforts on one side of the line — embodied recently by the proposed Warriors Arena at Piers 30-32, 8 Washington and other waterfront condo complexes, and other projects that intensify building along the water — that puts more pressure on the city to compensate with stronger sustainability initiatives.

“The natural thing to do with most of our waterfront would be to open it up to the public,” said Jon Golinger, who is leading this year’s referendum campaign to overturn the approval of 8 Washington. “But if the lens you’re looking through is just the balance sheet and quarterly profits, the most valuable land maybe in the world is San Francisco’s waterfront.”

He and others — including SF Waterfront Alliance, a new group formed to oppose the Warriors Arena — say the city is long overdue in updating its development plan for the waterfront, as Prop. H in 1990 called for every five years. They criticize the city and Port for letting developers push projects without a larger vision.

“We are extremely concerned with what’s happening on our shorelines,” said Michelle Myers, director of the Sierra Club’s Bay Chapter, arguing that the city should be embracing waterfront open space that can handle storm surge instead of hardening the waterfront with new developments. “Why aren’t we thinking about those kinds of projects on our shoreline?”

David Lewis, director of Save the Bay, told us cities need to think less about the value of waterfront real estate and do what it can to facilitate the rising bay. “There are waterfront projects that are not appropriate,” Lewis said. Projects he puts in that category range from a scuttled proposal to build around 10,000 homes on the Cargill Salt Flats in Redwood City to the Warriors Arena on Piers 30-32.

“We told the mayor before it was even announced that it is not a legal use of the pier,” Lewis said, arguing it violated state law preserving the waterfront for maritime and public uses. “There’s no reason that an arena has to be out on the water on a crumbling pier.”

But Brad Benson and Diana Oshima, who work on waterfront planning issue for the Port of San Francisco, say that most of San Francisco’s shoreline was hardened almost a century ago, and that most of the planning for how to use it has already been done.

“You have a few seawall lots and a few piers that could be development sites, but not many. Do we need a whole plan for that?” Benson said, while Oshima praises the proactive transportation planning work now underway: “There has never been this level of land use and transportation planning at such an early stage.”

The Bay Conservation and Development Commission was founded almost 50 years ago to regulate development in and around the Bay, when the concern was mostly about the bay shrinking as San Francisco and other cities dumped fill along the shoreline to build San Francisco International Airport, much of the Financial District, and other expansive real estate plans.

Now, the mission of the agency has flipped.

“Instead of the bay getting smaller, the bay is getting larger with this thing called sea level rise,” BCDC Executive Director Larry Goldspan said as we took in the commanding view of the water from his office at 50 California Street.

A few years ago, as the climate change predictions kept worsening, the mission of BCDC began to focus on that new reality. “How do we create a resilient shoreline and protect assets?” was how Goldspan put it, noting that few simply accept the inundation that BCDC’s sea level rise maps predict. “Nobody is talking about retreating from SFO, or Oakland Airport, or BART.”

That means Bay Area cities will have to accept softening parts of the shoreline — allowing for more tidal marshes and open space that can accept flooding in order to harden, or protect, other critical areas. The rising water has to go somewhere.

“Is there a way to use natural infrastructure to soften the effect of sea level rises?” Goldspan asked. “I don’t know that there are, but you have to use every tool in the smartest way to deal with this challenge.”

And San Francisco seems to be holding firm on increased development — in an area that isn’t adequately protected. “The seawall is part of the historic district that the Port established, but now we’re learning the seawall is too short,” Goldspan said.

BCDC requires San Francisco to remove a pier or other old landfill every time it reinforces or rebuilds a pier, on a one-to-one basis. So Oshima said the district is now studying what it can remove to make up for the work that was done to shore up Piers 23-27, which will become a new cruise ship terminal once the America’s Cup finishes using it a staging ground this summer.

Yet essentially giving up valuable waterfront real estate isn’t easy for any city, and cities have both autonomy and a motivation to thrive under existing economic realities. “California has a history of local control. Cities are strong,” Goldspan said, noting that sustainability may require sacrifice. “It will be a policy discussion at the city level. It’s a new discussion, and we’re just in the early stages.”

 

NEW WORLD

Global capitalism either grows or dies. Some modern economists argue otherwise — that a sustainable future with a mature, stable economy is possible. But that takes a huge leap of faith — and it may be the only way to avoid catastrophic climate change.

“In the world we grew up in, our most ingrained economic and political habit was growth; it’s the reflex we’re going to have to temper, and it’s going to be tough.” Bill McKibben writes in Eaarth: Making a Life on a Tough New Planet. “Across partisan lines, for the two hundred years since Adam Smith, we’ve assumed that more is better, and that the answer to any problem is another burst of expansion.”

In a telephone interview with the Guardian, McKibben discussed the role that San Francisco could and should be playing as part of that awakening.

“No one knows exactly what economy the world is moving toward, but we can sense some of its dimensions: more localized, less material-based, more innovative; these are things that San Francisco is good at,” he told us, noting the shift in priorities that entails. “We need to do conservation, but it’s true that we also need to build more renewable power capacity.”

Right now, CleanPowerSF is the only mechanism the city has for doing renewable energy projects, and it’s under attack on several fronts before it even launches. Most of the arguments against it are economic — after all, renewable power costs more than coal — and McKibben concedes that cities are often constrained by economic realities.

Some city officials argue that it’s more sustainable for San Francisco to grow and develop than suburban areas — thus negating some criticism that too much economic development is bad for the environment — and Radulovich concedes there’s a certain truth to that argument.

“But is it as green as it ought to be? Is it green enough to be sustainable and avert the disaster? And the answer is no,” Radulovich said.

For example, he questioned, “Why are we building 600,000 square feet of automobile-oriented big box development on Hunters Point?” Similarly, if San Francisco were really taking rising seas seriously, should the city be pouring billions of dollars into housing on disappearing Treasure Island?

“I think it’s a really interesting macro-question,” Jennifer Matz, who runs the Mayors Office of Economic Development, said when we asked whether the aggressive promotion of economic development and growth can ever be sustainable, or whether slowing that rate needs to be part of the solution. “I don’t know that’s feasible. Dynamic cities will want to continue to grow.”

Yet that means accepting the altered climate of new world, including greatly reduced fresh water supplies for Northern California, which is part of the current discussions.

“A lot of the focus on climate change has moved to adaptation, but even that is something we aren’t really addressing,” Radulovich said.

Nutter agreed that adapting to the changing world is conversation that is important: “All of the development and planning we’re doing today needs to incorporate these adaptation strategies, which we’re just initiating.”

But environmentalists and a growing number of political officials say that San Francisco and other big cities are going to need to conceive of growth in new ways if they want to move toward sustainability. “The previous ethos was progress at any cost — develop, develop, develop,” Myers said, with the role of environmentalists being to mitigate damage to the surrounding ecosystem. But now, the economic system itself is causing irreversible damage on a global level. “At this point, it’s about more than conservation and protecting habitat. It’s about self-preservation.”

Treasure Island: Is this the end?

So Mayor Lee goes to China with plans to celebrate the signing of a deal that would bring $1.7 billion in Chinese investment into the lagging Treasure Island redevelopment project, and instead the whole thing falls apart. Not good for the cross-Bay rivalry: Gov. Brown, a former mayor of Oakland, landed $1.8 billion in Chinese money for his city’s big project, while Lee lost out.

But there’s a bigger problem. It’s hard to see how anyone would want to invest in Treasure Island right now, when:

The island is sinking,

The Bay is rising,

There’s only one way on or off the island, and it’s already so crowded that a modest event like the Treasure Island Flea Market ties up traffic in both directions for hours, and

The place is radioactive.

Matt Smith and Katherine Mieszkowski of the Bay Citizen did what the Navy and the city of San Francisco refused to do. They went out with a couple of red buckets, dug up some soil and had it tested for Cesium-137. Bingo: The place suffers from far worse contamination that anyone was letting on. And there might be even more:

Until the early 1990s, the Navy operated atomic warfare training academies on Treasure Island, using instruction materials and devices that included radioactive plutonium, cesium, tritium, cadmium, strontium, krypton and cobalt. These supplies were stored at various locations around the former base, including supply depots, classrooms and vaults, and in and around a mocked-up atomic warfare training ship – the USS Pandemonium. CIR’s samples were taken from under a palm tree 50 feet from a classroom building where cesium-137 was kept, according to military archives. A 1974 radiation safety audit identified cesium samples used and stored there with radioactivity several times the amount necessary to injure or kill someone who mishandled them. In 1993, shipping manifests from the same building showed even greater amounts of cesium-137 taken away from the same site that year.

Now some experts say that development plans need to be put on hold while the entire place is checked out more carefully:

“The fact that there is a level above standards is a clear mandate for further study and assessment of the extent of contamination and its origin,” Beyea wrote in an email, adding that more systematic testing is particularly important given that public play areas are planned nearby. “Building a playfield is not an appropriate plan at this time,” he wrote, “given the tendency for little children to put things in their mouths.”

Would you loan a couple billion dollars for a development project on that site?

In theory, of course, the Navy is responsible for the cleanup. In practice? Good luck with that. The Pentagon is blaming the sequester for forced budget cuts in everything including the Blue Angels; you think anyone’s going to write a very big check any time soon for a very complex environmental clean-up job on an artificial island that will soon be underwater?

I used to think the best thing to do with Treasure Island was to leave as much open space as possible for soccer and baseball fields, then slowly let it sink back into the Bay. Now apparently it’s a bad idea even to have kids playing there.

And what about the people who already have moved into housing at TI? Anyone going to test their soil?

Anyone want to take bets on whether anything much is ever going to be built there?

Checks from mayor’s mysterious breakfast companions mysteriously absent

In less than three months, custom made super yachts will zip around the San Francisco Bay in the ultimate competition for the prized America’s Cup. But San Francisco could wind up spending millions more than originally expected to host this prestigious sailing regatta.

At a March 13 committee hearing at the Board of Supervisors, America’s Cup Organizing Committee CEO Kyri McClellan reported that Mayor Ed Lee was investing an “incredible amount of energy” into helping ACOC with fundraising efforts to avert a city funding shortfall. He was even said to be hosting “breakfasts with CEOs” to solicit funding, McClellan said.

Who are the CEOs? Nobody will say.

How much has each of them pledged to give? Nobody will say.

When the Guardian submitted these questions to Lee, McClellan, and Stefanie Roumeliotes – whose SGR Consulting firm was wheeled in at the last minute to organize fundraising events – none answered directly.

McClellan responded on April 9 with a copy of a letter she sent to Mayor Lee and Board President David Chiu on the day of the hearing, which she indicated was “the most recent update on fundraising.” Roumeliotes, for her part, told the Guardian flat out to stop calling, because her firm was not going to answer any questions.

So far, it appears that none of the mayor’s fundraising meetings, which took place from January 25 to March 4, resulted in his unnamed breakfast companions writing out actual donation checks.

Had they contributed funding, the donation amounts would have been reflected in “behested payment” forms filed with the San Francisco Ethics Commission, required under state law to be submitted 30 days after a contribution is made.

Elected officials are “supposed to file behested payment [forms] for … legislative, governmental or charitable purposes,” Ethics Commission chief John St. Croix told the Guardian, so donations relating to the America’s Cup would fall squarely into this category. Those forms are supposed to filed internally by department, then sent onto Ethics. So far, none have been recorded.

“If there are such forms that the mayor filled out,” St. Croix told the Guardian, “they’re not getting forwarded.”

Meanwhile, McClellan’s March 13 letter suggests that recent fundraising efforts have yielded only $1.4 million – which won’t actually be in hand till next year. That’s a far cry from the estimated $15.6 million funding gap race organizers say is needed to cover San Francisco’s estimated $22.5 million billionaires’ boat race tab. As the fundraising arm of the race organizing committee, ACOC promised in an initial agreement that it would “endeavor to raise” the amount needed to defray city costs. Thus far, it’s paid $6.8 million.

In her letter to Lee and Chiu, McClellan suggested that roughly $13 million of that $15.6 million shortfall would be accounted for in “forecast General Fund revenues.” That translates to additional money harvested from visitors’ pockets via sales and hotel taxes, with some payroll taxes and parking fees sprinkled in, all associated with the America’s Cup events. Little-guy money.

And thanks to the little guys, ACOC’s new fundraising goal is much more attainable. “The SFACOC continues to endeavor to raise the funds,” McClellan wrote. “At a minimum that is $2,670,851 of which we already have $1,400,000 in existing pledges that are to be received by January 2014.”

 

ABC shows more concern about expanding police video surveillance than Mayor Lee

The SFPD has quietly expanded its reach and authority to obtain video surveillance from in and around bars, clubs, and markets through a condition it has begun recommending on new liquor licenses, as I reported in today’s issue, effectively bypassing controls on city-operated surveillance cameras established through extensive public hearings in 2005.

But the Mayor’s Office doesn’t seem concerned about the new trend, echoing SFPD’s point that it is the California Department of Alcoholic Beverage Control that decides whether to heed the SFPD’s request to include the video surveillance condition. “There is no new policy. SFPD makes recommendations as far as I know, not requirements,” Mayoral Press Secretary Christine Falvey wrote to me in an email responses to our questions.

Certainly, everyone from bar owners to the ACLU to Sups. Scott Wiener and David Campos – who have called a hearing on the policy for later this month – consider it a new policy, or at least one that the public has just learned of after it was adopted internally right after the idea was shot down in public hearings in 2011.

ABC spokesperson John Carr had told me the department “routinely denied requests for conditions by SFPD per section 23800(e) of the Californian Business and Professions Code, occasionally these denials include the surveillance condition,” but he wasn’t able to provide me any examples of that happening by press time.

But today, he was able to find one. On Oct. 3, 2012, ABC rejected the SFPD’s request for video surveillance at Bush Market at 820 Bush on a quiet residential block of Nob Hill, noting that state law requires such requests be supported by “substantial evidence” that problems exist at the site that would be mitigated by the condition.

“I regret to inform you that the Department is unable to impose conditions pursuant to your request because no evidence was provided to establish that a problem exists at the premises or in it immediate vicinity,” ABC District Administrator Justin Gebb wrote in what was essentially a form letter.

Carr shared an identical letter that the ABC sent to the SFPD denying some of its requested conditions for another liquor license transfer on Feb. 12, this one for the Space 550 event venue at 550 Barneveld Ave. But in that case, the ABC decided to support the SFPD’s request for video surveillance “that is able to view the inside and outside of the premises” and which must be given to the cops “upon demand.”

As I wrote in this week’s paper, the ACLU considers that kind of extrajudicial expansion of the SFPD’s ability to require and obtain video surveillance to be unconstitutional, and we furnished a copy of the article and the issues it raised to try to get a more substantial comment from the Mayor’s Office, which seems to be less concerned with the civil rights of San Franciscans than the bureaucrats in Sacramento are.

“Balancing public safety with vibrant cultural and nightlife activities is a concern of mayor. He expects the Police Department to work in partnership with the neighborhood and its businesses to lawfully collect evidence that can help keep the public safe and neighborhoods active,” Falvey wrote.

So I had a few follow-up questions, for which I’m still awaiting answers, and I’ll update this post if and when I get them: “The ACLU’s position is that this is not a lawful way to collect evidence, and that it violates the state constitution’s privacy protections and the rules San Francisco established in 2005 regulating when and how the SFPD may request and use video surveillance. Does the mayor reject those concerns and has he sought any legal advice to support his position? In the absence of any judicial review, shouldn’t the city have some guidelines and policies governing this expansion of SFPD’s video surveillance authority? Does the mayor believe the 2005 guidelines should no longer apply? And does the mayor agree with Sups. Wiener and Campos that it would be appropriate to have a public hearing on this issue, particularly given the strong public opposition to requiring expanded video surveillance by bars two years ago?”

The Board of Supervisors today declared April 9 Pay Equity Day in San Francisco, in recognition of the persistent national gap between male and female financial compensation. But with the city locked in a dispute with SEIU Local 1021 over pay cuts to jobs dominated by women and workers of color, the day took on special local significance. Ahead of the declaration, union members, activists, and supervisors rallied in front of City Hall, chanting against San Francisco’s wage inequality and the general climate of fiscal austerity.

Women in San Francisco earn just 84 cents for every dollar paid to their male counterparts. Although this figure is slightly higher than the national average of 77 cents per dollar, the discrepancy represents a yearly wage gap of $9,968 per year, according to the National Partnership for Women and Families. At today’s press conference in front of City Hall, Sup. Malia Cohen called the gap “unconscionable in a country as wealthy as ours.”

Cohen was joined by Sups. David Chiu and David Campos, who both spoke out against gender-based wage gaps. “It is important for men to speak out,” Chui said. “It wasn’t women who made the decision for pay to be unequal.” Campos went a step further, promising to vote against any budget that further entrenches unequal pay. “I will not support any budget that reflect this discrepancy,” he said.

SEIU Local 1021, which represents over half of city employees, is currently locked in a budget dispute with the city over pay cuts that would adversely affect women and workers of color. The city Department of Human Resources has recommended that the city cut the salaries of 16 categories of city workers, including personnel clerks and nursing technicians, which are disproportionately females and workers of color. The dispute was recently sent to an arbitrator.

At today’s event, local SEIU leaders and the San Francisco Women’s Political Committee (SFWPC) continued to pressure the city to reconsider the salary cuts. SFWPC President Laura Hahn called persistent pay inequality “embarrassing.”

“If we can’t achieve it here in San Francisco where are we going to do it?” she asked.

Former Supervisor Chris Daly, who now works as political director for SEIU 1021, echoed Hahn’s concerns and charged that the proposal to cut pay for female-dominated categories calls into question the city’s long term commitment to pay equity.

“If you ask Mayor Lee if he supports wage equality, of course he will say yes,” Daly told us. “But in reality, his Department of Human Resources is rolling back progress.” Daly’s repeated requests for Mayor Lee to intervene in the wage-cut arbitration have not yet been answered.
But for the DHR, the recommended cuts have more to do with fiscal reality than gender equality. At a March 7th budget hearing, DHR director Micki Callahan said, “It would be improper to base any decision on demographics.”

She voiced concern over the “root causes” of pay discrepancy, but indicated that these issues fall outside the purview of her department. Spokespeople for the the DHR department have repeatedly assured us that the proposed budget cuts have nothing to do with gender, but rather reflect an effort to bring city salaries in line with market forces.

Mayor Lee’s trip to China raises questions of ethics and influence

[UPDATED(x3)] Mayor Ed Lee barely had time to unpack from his recent political junket to Paris before he was off on his current trip to China – both of which were paid for and accompanied by some of his top political supporters and among the city’s most influential power brokers. No wonder Lee doesn’t have time to weigh in on Airbnb’s tax dodge, the condo conversion stalemate, or other important city issues.

Local good government advocate Charles Marsteller learned of the current China trip from Willie Brown’s column in Sunday’s San Francisco Chronicle, whose editors (including Editor Ward Bushee, who we’re still waiting to hear back from about this trip) consider it a “man about town” column immune from conflict-of-interest policies that normally require journalists to disclose who is paying them on the side.

“I’m here with Mayor Ed Lee for my seventh official visit,” Brown cheerfully wrote, although readers were left to wonder just what official business Brown might be conducting with our mayor and his entourage. So, being an expert on political disclosure laws, Marsteller went down to the Ethics Commission to pull the Form SFEC-3.216(d) that state law requires elected officials to file before leaving on trips paid for by outside interests.

But it wasn’t there, so Marsteller filed an official complaint with the commission, telling us, “I did so to impress upon our Elected and other City Officials the need to properly report gifts in a timely way and in the manner as called for by State law and on the forms provided by the SF Ethics Commission.” 

When we contacted mayoral Press Secretary Christine Falvey, she forwarded us a copy of the form that should have been filed before the trip and told us, “I’m not going to answer the question about why we failed to file the appropriate forms with the Ethics Commission, as we worked closely with the City Attorney’s office to exceed reporting requirements by all appropriate deadlines.” [UPDATE: The time stamp on the form indicated it was filed on May 25, before the trip, even though it wasn’t publicly available at the Ethics Commission office when Marsteller went down to look for it].

The form indicates that Lee’s portion of the trip was paid for by the San Francisco Chinese Chamber of Commerce, whose influential leader Rose Pak conspired with Brown to get Lee appointed mayor more than two years ago. This is also the same Rose Pak who was admonished by the state’s Fair Political Practices Commission for illegally funding another political junket to China in 2009 with Sups. David Chiu and Eric Mar and then-Sup. Carmen Chu, who Lee appointed as Assessor earlier this year.

Those officials were forced to repay the expenses after the FPPC found that Pak, that time acting under the auspices of the Chinese New Year Festival Committee, was not allowed to make gifts exceeding $420 per official that year. “Please be advised that since the Chinese New Year Festival Committee is not an organization that falls under Section 501(c)(3) of the Internal Revenue Code, no public official may accept gifts of any type from this organization valued in excess of the applicable limit,” FPPC counsel Zachary Norton wrote in an Aug. 22, 2011 enforcement letter to Pak.

In other words, because this committee and “other 501(c)(6) chamber of commerce organization[s]” are in the business of actively lobbying top elected officials for favorable policies, rulings, and projects, they are barred by ethics law from giving them the gifts of big overseas political junkets. As Marsteller noted in his complaint letter, violations are punishable by fines of $5,000 per violation, or if they are “willful violations of the law” – which doing the same thing you were sanctioned for just two years ago certainly might be considered – the criminal penalties are $10,000 per violation or up to a year in jail.

Mayor Lee’s portion of the trip cost the Chamber $11,970, according to the form. But this time, to get around the FPPC restrictions, Pak seems to have passed the hat among various business elites to fund the trip. The mayor’s form shows that 41 people paid up to the current gift limit of $440 “to defray the cost of the mayor’s trip.”

They include Pak, Brown, four people from Kwan Wo Construction, three from American Pacific International Capital, two each from Boyett Construction, Young Electric, and Bel Builders, Harbor View Holdings Director Gorretti Lo Lui, and SF Immigration Rights Commissioner Sonya Molodetskaya – most of whom were also part of the trip’s 43-member delegation.

Among others who tagged along for the trip are Public Works Director Mohammed Nuru (who has a history of political corruption under Mayors Brown and Newsom and no clear business being on a Chinese trade delegation, but who doesn’t love a free trip?!), Kofi Bonner from Lennar Home Builders, Harlan Kelly with the SFPUC, Jay Xu with the Asian Art Museum, the wives of Lee and Bonner, Kandace Bender with San Francisco International Airport, and Mark Chandler with the Mayor’s Office of International Trade and Commerce.

It’s not clear who paid for those other public officials or even what they were doing there. [UPDATE: Department of Public Works spokesperson Rachel Gordon told us that Nuru paid for the trip himself, but that he’ll be studying China’s instrastructure, from its separated bikesways to greening of public rights-of-way, as well as meeting with Chinese businesses involved in the redevelopment of Hunter’s Point. “He’s been looking at a lot of the infrastructure in China,” Gordon said. “I expect a dozen if not more ideas when he returns.”] Then again, it also wasn’t clear why venture capitalist Ron Conway – Lee’s top campaign fundraiser and possible reason for publicly subsidizing big tech companies, including many that Conway funds – joined and helped sponsor Lee’s recent trip to Paris. This is just how business gets done in San Francisco.

“Willie Brown is the former Mayor of San Francisco,” Falvey told us when we asked why Brown was on the trip and what its purpose was. “The purpose of the trip is to promote San Francisco, its local manufacturing, cultural exchanges, he is signing an MOU and meeting with high level, new Chinese government officials.”

[UPDATE 4/5: Marsteller has withdrawn his complaint from the Ethics Commission alleging the mayor’s form wasn’t filed on time, but he and another citizen have filed separate complaints with the FPPC alleging the trip and its funding mechanism may violate the agency’s 2011 ruling against Pak.]

Mayor Lee’s mysterious breakfast companions [UPDATED]

See an update to this story below. San Francisco Mayor Ed Lee has been having breakfast with CEOs to seek millions in funding for the America’s Cup, but the identities of those CEOs remain a mystery.

At a City Hall hearing two weeks ago, America’s Cup Organizing Committee chief Kyri McClellan told supervisors that Lee has been “putting an incredible amount of energy” into fundraising to cover city costs for the America’s Cup. As the yacht race draws closer, pressure is building around an anticipated funding shortfall that could deal a blow to city coffers.

McClellan told supervisors that Lee was “holding breakfasts with CEOs” to raise money. Encouragingly, she added, “people are responding.”

So, who are the CEOs? And how much have they agreed to contribute? So far, nobody has disclosed that information.

Shortly after the hearing, the Guardian submitted a public records request to Lee’s office seeking documentation on the fundraising breakfasts and records showing the names and affiliations of the CEOs.

In response, we received several pages from the mayor’s calendar. Entries show that Lee held half a dozen meetings concerning “economic development,” with no mention of the America’s Cup. The mayor had a meeting at Waterbar, a restaurant on the Embarcadero overlooking the Bay Bridge, on the morning of Jan. 25; he had another meeting there Feb. 1; he met at the Hotel Vitale on Feb. 22; met at City Hall on Feb. 28; had breakfast at the St. Regis Hotel on March 1, and had lunch with someone at Original Joe’s on March 4. But there was no information disclosing whom he met with.

After receiving the documents, the Guardian left multiple voicemails with the mayor’s press office asking for the identities of the CEOs. So far, nobody has responded.

The request also yielded a fundraising form that asks prospective donors to “join the 2013 America’s Cup San Francisco Host Committee.”

Donors could opt to become a “Legacy Benefactor” for committing to give or raise $5 million; a “Legacy Partner” for $2.5 million; a “Strategic Partner” for $1 million, a “Civic Champion” for $500,000, or a mere “Member” for $250,000. Donors with questions or who wished “to connect with Mayor Lee” could call Stephanie Roumeliotes, the form noted. 

Roumeliotes is a prominent fundraiser and political strategist who provided financial consulting for the re-election campaigns of Senators Dianne Feinstein and Barbara Boxer. She was appointed to serve on the Golden Gate Concourse Authority, a part of the Recreation and Parks Department, by former Mayor Gavin Newsom.

A call to the number listed went to SGR Consulting, Roumeliotes’ firm. The receptionist declined to comment or to connect the Guardian with Roumeliotes, saying, “All press inquiries should be directed to the Mayor’s Office.”

UPDATE: We just received a voicemail from Christine Falvey, Mayor Lee’s press secretary, who told us “I don’t have a list of the attendees for those breakfasts. They were hosted by the America’s Cup Organizing Committee.” Which raises more questions, but in any case we placed a call to race organizers and will update again when we know more.
