Mayor Ed Lee’s committee gives $10,000 that it doesn’t have to the 8 Washington project UPDATED

Mayor Ed Lee presents himself as a model of fiscal responsibility, but the Mayor Ed Lee for San Francisco Committee that he controls has recently been spending big money that it doesn’t have, including more than $10,000 that it has recently given to the Yes on Propositions B&C campaign, according to campaign finance filings.

The Mayor Ed Lee for San Francisco Committee, a general purpose committee that Lee and its Treasurer Kevin Heneghan are jointly responsible for, made late contributions of $8,666.66 on Oct. 29 and $1,667 on Oct. 30 to San Franciscans for Parks, Jobs and Housing, Yes on Props. B&C, which supports the 8 Washington project. Lee’s committee also made a $4,333.34 contribution to the Yes on A campaign on Oct. 29.

The Lee committee’s contributions are actually small potatoes for the Yes on B&C campaign, which is spending more than $2 million to have voters green-light the project, most of it coming from the developer, Pacific Waterfront Partners, which kicked in late contributions of $450,000 on Oct. 28 and $250,000 on Oct. 24, bringing its total to about $1.8 million.

But what’s interesting about the Lee committee’s donations is that the final pre-election statement that it filed on Oct. 24 showed that it had just $1,208 in the bank and $26,886 in outstanding debts — most of that to Oakland-based EMC Research for polling it conducted during the Sept. 22-Oct. 19 period.

Neither Heneghan nor Lee responded to our calls for comment, and Lee doesn’t have any public events scheduled between now and election day on Tuesday, so details on this intriguing bit of deficit spending and what kind of polling work the mayor’s committee was doing remain a mystery. [UPDATE 11/5: Lee’s office deferred to Heneghan, who just emailed us this response: “As you know, political committee report filings are a snapshot in time. The Mayor Ed Lee for San Francisco ballot measure committee has received additional contributions since the most recent report that will be appropriately reported. All activity through the committee in support of ballot measures endorsed by Mayor Lee will continue to be appropriately reported as well.” We asked Heneghan whether he would disclose the donors, and we’re waiting to hear back.]

The Mayor Ed Lee for San Francisco Committee hasn’t reported raising any money this year, unlike last year when it raised about $400,000 from some of the city’s biggest establishment players, including Lennar Homes ($35,000), Committee on Jobs ($30,000), San Francisco Alliance for Jobs and Sustainable Growth ($25,000 in basically a pass-through from venture capitalist Ron Conway), San Francisco Association of Realtors ($20,000), and the city’s police and firefighters’ unions ($10,000 each).

But how exactly could the Mayor Ed Lee for San Francisco Committee give $10,000 to the Yes on Props. B&C campaign if it didn’t actually have the money to cover the checks?

When we asked a source at San Francisco Ethics Commission about it, at first he was puzzled, and then he told us that while the committee is required to report late expenditures that it makes before the election, it isn’t required to report late contributions that it receives. That we won’t find out until its Form 460s are due Jan. 31, 2014.

So who really paid for Lee’s contributions to the Yes on B&C campaign, as well as more than $20,000 in polling work that Lee’s committee paid for? And what will our mayor do in return for the people who are digging his committee out of its debts?  

 

Angered by senior evictions, Filipino American activists decline award

The board members of a local Filipino heritage organization, with ties to a high-profile eviction defense battle at San Francisco’s International Hotel in the late 1970s, have declined to an accept an award that San Francisco Mayor Ed Lee had planned to extend to them as part of a Filipino American History celebration because they are angry about a growing trend of senior evictions.

In a written statement sent to media by board member Tony Robles, the Manilatown Heritage Foundation explained that it couldn’t accept the award as long as “elders are being preyed upon, evicted and given a de facto death sentence thereof.”

The Manilatown Heritage Foundation board members were informed by Board of Supervisors President David Chiu that Lee had planned to recognize the I-Hotel as part of an annual cultural history celebration at City Hall, the statement noted. “Part of the occasion was to honor the I-Hotel and its many tenants and activists for its contribution to Filipino American history,” board members explained.

In 1976, the I-Hotel was targeted for demolition, prompting an historic eviction defense battle led by housing activists who rallied to the defense of the impacted tenants. A significant fixture in what was once a predominantly Filipino neighborhood known as Manilatown, the I-Hotel housed 196 tenants, predominantly low-income Filipino immigrants. 

“The I-Hotel fight was for dignity and it lived by the premise that housing is a human right,” Manilatown Heritage Foundation members explained in the written statement. “The fight for the I-Hotel galvanized the community around the fight for affordable housing, particularly for seniors—who sacrificed much and on whose shoulders we stand. The fight included tenants, elders, activists, artists and students who recognized that the real estate developers and financial interests were out of control—power unchecked.” 

The fight dragged on, at one point more than two thousand people surrounded the building to blockade the doors in an effort to prevent an eviction from going forward. The battle over the I-Hotel also brought on a famous San Francisco episode in which then-Sheriff Richard Hongisto served five days in his own jail for refusing to carry out the eviction order. In the end, the tenants were finally ousted. But the epic battle ultimately helped to produce a different outcome, many years later: The property became the site of low-cost senior housing, complete with a commemorative display in the interior documenting the dramatic I-Hotel fight.

As a young attorney who worked with the Asian Law Caucus, San Francisco Mayor Ed Lee was involved in that fight – as an activist defending tenants’ rights to stay. He frequently referred to this chapter of his personal history while running for mayor in 2011, to demonstrate his sensitivity to concerns about affordable housing.

But now that Lee is well into his mayoral term, a surge of evictions of low-income seniors is worsening on his watch. Tenant defense organizations such as Eviction Free San Francisco are showing up outside landlords’ homes and offices to protest eviction notices that threaten to push low-income seniors with few options out of the city. Some evictions have caught the attention of mainstream media, such as the ouster of elderly Chinatown couple Gum Gee Lee and Poor Heung Lee and their disabled daughter, Shiuman Lee.

Some advocates have proposed legislative solutions; meanwhile, the situation has evidently become so criticial that even city’s Human Services Agency is seeking outside assistance to provide eviction prevention services for elderly and disabled tenants facing Ellis Act evictions.

And today, the board of the Manilatown Heritage Foundation drew a line in the sand to send Lee a clear message by refusing to accept the honor of recognition in the current housing climate. So far, mayoral spokesperson Christine Falvey has not responded to the Bay Guardian’s request for comment in response to the Manilatown Heritage Foundation’s statement.

“Given the current state of San Francisco housing by forces out to make a killing by killing our communities, we as the torch bearers of the I-Hotel struggle and in the memory of its displaced elders and advocates Al Robles, Bill Sorro, Felix Ayson, Wahat Tampao and others, cannot, in good consciousness, accept any honor or award while elders are being preyed upon, evicted and given a de facto death sentence thereof. And it doesn’t matter if the honor is bestowed by Mayor Lee, President Obama or the pope. We have to say no.”

Zombies to attack City Hall! UPDATED

We in the Bay Guardian newsroom have just received word of an impending zombie attack on City Hall. I repeat: Zombies are planning to attack City Hall this afternoon! [Updated coverage from the scene below]

Oh, wait, it looks like it’s actually going to be City College of San Francisco students and supporters — dressed as zombies and other Halloween creatures — that will be descending on City Hall around 4pm today (Thurs/31). Okay, maybe this isn’t as big a deal as an actual zombie attack, but it’s still newsworthy.

The faux-zombies came to see Mayor Ed Lee to demand that he stop supporting the state takeover of CCSF and that he stand up for local control over this important, low-cost educational institution. The San Francisco-elected college’s board of trustees’ powers were given to Special Trustee Bob Agrella, who was in turn appointed by the California Community College Chancellor Brice Harris.

At the rally Alisa Messer, CCSF’s local faculty union president, called for Lee to push for the board’s reinstatement.

“We’re calling on Mayor Lee to ask the state chancellor to restore democracy at City College,” Messer said, “We want our board restored next year. Not two years from now, not three years from now, next year!” 

She also called on the mayor to demand that Accrediting Commission for Community and Junior Colleges restore CCSF’s accreditation immediately.

Christine Falvey, the mayor’s spokesperson, wrote in an email to the Guardian that the mayor supports efforts to save CCSF — but only the ones he thinks will work.

“The mayor has said these are difficult times for the college, but that this is the time to commit to true reforms,” she wrote. “The mayor wants to focus his efforts on activities that will ultimately help the college stay open.” 

When asked if the mayor supported City Attorney Dennis Herrera’s lawsuit against the ACCJC meant to stop the closure of CCSF, she responded that the lawsuit may “go up and beyond” critical deadlines to save the college. The mayor has so far shown no support for any of the efforts to combat the ACCJC, despite multiple lawsuits against the accreditors as well as condemnation from the U.S. Department of Education of their practices.

The zombie march will began at 3:30pm, at the CCSF Downtown Campus, 750 Eddy Street, and hundreds of protesters arrived at City Hall around 4pm — to see if there’s anyone in City Hall with any brains.

 

 

Lee family quietly leaves home as activists pledge to push reforms

Members of Lee family quietly moved out of their longtime home in Chinatown last night, a day before their latest scheduled Ellis Act eviction, which had been postponed twice before thanks to headline-grabbing progressive activism that turned away deputies and persuaded the Mayor’s Office to intervene with the landlord.

But this time, the Mayor’s Office has been mum about the case (officials haven’t responded to our requests for comment) after failing to find a solution to the Lees – an elderly couple using Social Security to care their disabled 48-year-old daughter – still unresolved situation. With help from the Asian Law Caucus and Chinatown Community Development Center, the Lees moved their belongings into storage while they are staying in a hotel.

“The family is staying at a hotel in the city for the next few days as they try to finalize on a couple of potential rental units here. They’ll be paying over twice the amount that they had been paying for their rent-controlled unit. Their SSI won’t be enough to make ends meet, and so they will be spending down their relocation compensation, which may be depleted in the next several months,” Asian Law Caucus attorney Omar Calimbas told us. “Hopefully, the family will be able to find subsidized housing by then, or they will be in a precarious state of affairs again.”

Sheriff Ross Mirkarimi told us yesterday that he’s been waiting for word from the Mayor’s Office and hoping to avoid this evicting the family. “We’re duty bound. It’s a court order,” Mirkarimi said of his eviction obligation. “The eviction is on the books, but we’ve been expecting an alternative plan by the Mayor’s Office after he intervened in this case.”

The San Francisco Examiner, which had earlier given splashy credit to Mayor Ed Lee for stalling the Lee family’s eviction – to the irritation of some activists that probably deserve more credit than anyone in the Mayor’s Office – had the only journalist on the scene with the Lees last night, but the paper didn’t have any comments or updates from the Mayor’s Office.

Weeks before Mayor’s Lee’s headline-grabbing Sept. 25 intervention in the Lee case, Mirkarimi had his Eviction Assistance Unit contact the Lees and try to help them avoid being turned out with no place to go. But in a city where his office performs around 1,000 evictions per year – it executed 998 court-ordered evictions last year — the single full-time staffer in that office is overwhelmed.

“We need more staff to assist when it gets to this point,” Mirkarimi told us. But his budget request last year to add another position to the unit was denied by the Mayor’s Office and Board of Supervisors, a request that Mirkarimi renewed in a Sept. 30 letter to Mayor Lee.

“When there is a determination, our EAU attempts to support individuals and families facing eviction, not just Ellis Act evictions, but all evictions. This unit is comprised of one full time deputy sheriff and the partial time of another deputy.  Based on [the current eviction] trend, our EAU staffing is insufficient and ill-equipped to assist qualified individuals and families who may be at risk of becoming homeless,” Mirkarimi wrote. “With renewed focus on the consequences of evictions in San Francisco, I return to our FY 2013-2014 budget request to enhance our EAU with one full time clinical outreach worker.”

Meanwhile, the activists say they won’t wait for the next budget cycle or rely on the Sheriff’s Department for help with imminent evictions. They say that they plan to propose a package of reforms for dealing with the eviction crisis as soon as this week.

“Overall, the several weeks of reprieve from the eviction that were won after an incredible display of community solidarity with the Lees were very important in giving them time to find a temporary fix,” Calimbas told us. “Stay tuned in the next day or so for the next move by a growing coalition of community organizations, housing advocates and labor in pushing for a comprehensive package of legislative reform to curb the outbreak of displacement-based speculation.”

BEST OF THE BAY 2013: LOCAL HEROES

Bruce Brugmann, Jean Dibble, and Tim Redmond

The San Francisco Bay Guardian — which has had a significant impact on the Bay Area’s cultural and political dynamics and dialogue over the last 47 years — was largely the creation of three people with complementary skills and perspectives, an amalgam that gave the Guardian its voice and longevity.

Although they are no longer involved with running the paper, we’re honoring their contribution and legacy with a form of recognition they created: a Local Hero Award in our Best of the Bay issue, an annual edition that has been adopted by almost every alt-weekly in the country.

Bruce Brugmann and Jean Dibble launched the Guardian in October 1966 after years of planning by the married couple, and they ran it as co-publishers until the paper’s sale to the San Francisco Newspaper Co. last year, with Dibble running the business side and Brugmann in charge of editorial and serving as its most public face.

“We were one of the few husband and wife newspaper teams, a real mom and pop operation,” Brugmann told us. “We couldn’t have done it without the two of us, we needed both of our skill sets.”

They met in 1956 at the University of Nebraska, where Brugmann studied journalism and served as editor of the Daily Nebraskan, starting his long career as journalistic rabble-rouser. Dibble studied business, which she would continue in graduate school at Harvard University’s Radcliffe College while Brugmann got a master’s in journalism at Columbia University.

As graduation neared, they started talking about forming a newspaper together, an idea that percolated while Brugmann served in the US Army, where he wrote for Stars and Stripes, and Dibble moved to San Francisco with their two kids to work in personnel and administrative positions.

After the Army, they settled in Wisconsin, where Brugmann worked as a reporter for the Milwaukee Journal before moving to the Bay Area to work on launching the Guardian while Brugmann supported the family working for the Redwood City Tribune.

“We came out here with the idea of doing it and we immediately started planning. Jean did the prospectus, a damn good prospectus,” Brugmann said.

The Guardian published sporadically in the beginning, but it tapped into a vibrant counterculture that was clashing with the establishment and began publishing important articles highlighting inequities in the Vietnam War draft and exposing local political scandals, including how Pacific Gas & Electric illegally acquired its energy monopoly.

“A lot of it was just keep your head down and keep going,” Dibble said. “We never talked about alternatives, it was just what we were going to do.” The Guardian covered the successful revolts against new freeways in the city and plans to build Manhattan-style skyscrapers, publishing the book The Ultimate Highrise in 1971. In the mid-’70s, the Guardian won a successful unfair competition lawsuit against the Chronicle and the Examiner over their joint operating agreement, allowing the paper to become a free newsweekly. “Eventually, things got better, and we got some large advertisers in the ’80s and they really helped kick us off,” Dibble said. That was also when Tim Redmond, a journalist and activist steeped in radical politics, started writing for the Guardian, going on to serve as the paper’s executive editor and guiding voice for more than 30 years. “Tim was always more radical than I was,” Brugmann said, giving Redmond credit for the Guardian’s groundbreaking coverage of tenant, environmental, and economic justice issues. “Every publisher needs an editor who was more radical than they are to push them.” The two journalists had a prolific partnership, mentoring a string of journalists who would go on to national acclaim, turning the Guardian into a model for alt-weeklies across the country, exposing myriad scandals and emerging arts and cultural trends, and helping to write and pass the nation’s strongest local Sunshine Ordinance. “We always wanted to make things better,” Brugmann said of what drove the Guardian. “Even the battles that we lost, we got major concessions. Yerba Buena is much better because of the stories we did at the time, same thing with Mission Bay…San Francisco is much better that we were here. And we’re really proud and we appreciate the work of the current Guardian staff in keeping the Guardian flame alive.”

 

LOCAL HEROES: Kate Kendell

The night Proposition 8 passed was one of the hardest of Kate Kendell’s life. She remembers it with startling detail — and she should, because she was one of the most prominent opponents of the measure to overturn marriage equality in California.

“I was hopeful right up until the end that Prop. 8 would be defeated,” she said, speaking slowly as she pulled her thoughts from what sounded like a dark place. “Our initial polling numbers said we’d probably lose, but I really hoped in the deepest heart of my heart that when people got in there that they’d punch their vote in favor of the person they knew.”

But as the voters of California showed in that 2008 election, sometimes the good guys lose.

Kendell, executive director of the National Center for Lesbian Rights, fought the good fight since she started there in 1994. The NCLR litigates, creates policy, and performs outreach for LGBT civil rights on a national level, with headquarters in San Francisco. After years of anticipation, she poured herself into the campaign against the proposition that would make her marriage illegal, and then the measure passed.

That night she hung her head in disbelief. She felt physically ill, and her mind roiled in grief equaled only by the death of one of her parents. “It felt like that,” she said.

Kendell and her wife, Sandy, went home without speaking a word, and when she got in the door she tried to pull it together. Steeling herself to face her family, Kendell walked out of the bathroom and burst into tears. Her son said simply “this just means we have to fight more.”

So she did, and we all won.

That led to the moment for which Kendell may be remembered for a long time to come. When Prop. 8 was overturned by the US Supreme Court this year, a flock of San Francisco politicians descended the steps inside the rotunda at City Hall. Kendell took to the podium and spoke to the nation.

“My name is Kate Kendell with the National Center for Lesbian Rights,” she said, “and fuck you, Prop. 8!” The crowd erupted into cheers.

She regrets saying it now, but history will likely forgive her for being human. For someone whose own marriage’s validity was threatened and who spent two decades fighting for equality, she earned a moment of embarrassing honesty.

Kendell’s infamous declaration may be how she’s known, but one of her key decisions behind the scenes shaped the LGBT equality movement as well. When then-Mayor Gavin Newsom’s administration wanted a couple to be the first in his round of renegade gay marriages in 2004, it was Kendell who suggested Del Martin and Phyllis Lyon.

The two were in a relationship since 1953, pioneers of LGBT activism in San Francisco. Kendell said it was only right that they were first to read their vows in the city they helped shape. “Were it not for their contributions, visibility, and courage in the ’50s and ’60s, we wouldn’t be in that room with Newsom contemplating marriage licenses,” she said. “I’m just happy they said yes. It was absolutely appropriate.” And it’s with that sense of history that she herself pioneers forward, pushing in states across the US what Harvey Milk fought for in California — workplace protections for the LGBT community. “In 38 states, you can be fired from your job or being lesbian, gay, bisexual, or transgender. That has to change,” she said. “When the next chapter of history is written, it will be about a nation that treats the LGBT community as equals.”

 

Theo Ellington

Last year, when San Francisco Mayor Ed Lee floated the idea of implementing stop-and-frisk, a practice that many civil rights advocates say amounts to racial profiling, Theo Ellington stepped up to create a Change.org petition to oppose the idea — and won.

The policy would have given San Francisco police officers the authority to stop and search any individual who “looks suspicious,” in an effort to get guns off the streets.

“I found it was basically a predatory policing practice that didn’t belong in a city like San Francisco,” Ellington told us. His petition garnered a little more than 2,300 signatures, “enough to show policymakers we were paying attention,” he guesses. Faced with mounting pressure and a community outcry, Lee ultimately abandoned the idea.

“That was a win, I think, for everyone fighting for what’s really a civil right,” the 25-year-old, native San Franciscan told us in a recent phone interview. “It’s not a black issue or a white issue,” but it did strike a nerve and provide Ellington with some momentum for coalition building.

Ellington was born and raised in San Francisco’s Bayview Hunters Point neighborhood, home to a significant portion of the city’s dwindling black population. The campaign against stop-and-frisk helped catalyze his still-evolving political organization, the Black Young Democrats of San Francisco, of which he is president.

Go to BYDSF’s website and you’re confronted with some startling statistics about the experience of black San Franciscans: In the last 20 years, the African American community has dwindled to only 6 percent of the city’s population; meanwhile, the high school dropout rate stands at 38 percent, the unemployment rate is 18 percent, and the level of poverty stands at a disheartening 20 percent.

To tackle these looming challenges, BYDSF now faces the hurdle of getting local elected officials to care. “Since then, we have been trying to build our membership and figure out where we fit in the political climate of SF,” Ellington says.

His group’s chief concerns include closing the achievement gap in San Francisco public schools, doing something about the escalating cost of housing, and finding better solutions for public transit. “There’s the housing need, obviously. It’s a need that working class folks in general are facing,” he said.

He’s pursing a master’s degree in urban affairs at the University of San Francisco, and says he’s taken it upon himself to learn everything he can about how cities operate. To that end, he often ponders vexing questions: “How do you figure out a way to give those same opportunities to everyone? How do you provide opportunities for all income levels?”

His successful opposition campaign to stop-and-frisk didn’t stop Mayor Lee from appointing him to the Commission on Community Investment and Infrastructure, which oversees the successor to the San Francisco Redevelopment Agency. A major project under that body’s purview is the Hunters Point Shipyard development, a massive undertaking led by construction firm Lennar Urban, practically in Ellington’s backyard. Having grown up in the neighborhood, he sees himself as being in a unique position to ensure that the developers are providing jobs for local residents as required under the agreement. “It allows me to speak to both sides — on the community level, and in City Hall,” he said. “There are certain social dynamics you won’t understand unless you have lived in the community.” Ultimately, Ellington says, his goal is to push local politicians to find ways of making San Francisco a place where people of all income levels can find their way. “There’s a lot more work to do,” he said. “I think San Francisco is at a real pivotal point, where we can choose to go in the right direction … or we can choose the opposite.”

 

LOCAL HEROES: Shanell Williams

Shanell Williams is a chameleon activist, spearheading the effort to save City College of San Francisco from many fronts.

When City College fought off a statewide initiative to save money by stigmatizing struggling students, she defended the school as an Occupy activist. With a banner raised high, she faced down the California Community College Board of Governors, shouting their wrongs aloud at a meeting attended by hundreds. The board was stunned but her fellow activists were not, because that’s who Williams is: an uncompromising defender of San Francisco.

Now, as City College faces a fight for its existence, Williams is defending it again, this time as a duly elected CCSF student trustee.

Williams is at the forefront of Save CCSF, an Occupy-inspired group publicly protesting the Accrediting Commission of Community and Junior Colleges, the body trying to shut down City College. San Francisco is holding its breath until next July to hear if the accrediting commission will close the city’s only community college — and Williams was one of the key organizers helping students’ voices rise up to decry the decision to close the school.

She has reason to fight hard, growing up watching her community ravaged by those in power who purported to do good. She is a black woman and San Francisco native raised in the Fillmore and the long history of redevelopment and its role in the flight of The City’s African American population shaped her ethos. To Williams, there are forces that care about money at the expense of communities and those forces need to be fought.

“How are we supporting people to have a decent quality of life?” she said, and that’s the way she’s approached saving her community since a young age.

In 2003, while in high school, Williams got a taste of politicking as a member of San Francisco’s Youth Commission, appointed by then-Mayor Willie Brown. “I think he’s a very interesting character with a lot of influence over the city,” she said, with just an edge of steel to her voice.

As a teenaged politician, she discovered the work of the Human Rights Commission and was inspired. While a student of Washington High School and then Wallenberg High, she had a tough home life and entered the foster care system, getting a firsthand look at how the state takes care of its youth.

It galvanized her, honed her, and made her yearn for change. “I just innately had a sense of wanting to see justice and fairness,” she said.

Energized, she joined the Center for Young Women’s Development, the Youth Treatment Education Court, Urban Services YMCA, the Youth Leadership Institute, and more. She joined so many organizations and taught so many youth and government officials that even she can’t remember all of them off the top of her head.

At one point, she even taught judges across the country about cultural competency. “We had this whole spoken word performance thing we did,” she said, laughing.

In 2010, as Williams took classes at City College, she waved the banner defending San Francisco’s community college students. She pushed for city-level minimum wage requirements for City College workers, who earned dollars less. She also pushed back against state requirements to cut off priority registrations to those who took too long in the community college system — because she’s been there herself.

“They need a few chances to get it right and become a good student,” she said. When the struggle to save City College is done, win or lose, Williams sees herself remaining an advocate for students for years to come. At 29 years old, she’s still a student herself, and she eagerly awaits the day she’ll transfer to Cal or Stanford as an Urban Studies major. It all comes back to defending her city. “We have to broaden the movement,” she said. “The enemy is not about color, it’s about wealth inequality. It’s not just about City College either. It’s about the austerity regime that doesn’t care about working class people and poor folks.”

When the San Francisco Mayor’s Office cut a deal with Sutter Health and its California Pacific Medical Center affiliate for an ambitious rebuild of hospital facilities — which would shape healthcare services in San Francisco for years to come — community activists began to find serious flaws in the proposal.

So they organized and banded together into a coalition to challenge the powerful players pushing the plan, eventually helping to hash out a better agreement that would benefit all San Franciscans. Representing an alliance between labor and community advocates, the coalition was called San Franciscans for Healthcare, Jobs, and Justice.

When the whole affair began, it seemed as if the CPMC rebuild would incorporate a host of community benefits — but those promises evaporated after the healthcare provider walked away from the negotiating table, unhappy with the terms.

Then a second agreement, with much weaker public benefits, came out of a second round of talks between CPMC and the Mayor’s Office. But by then, so much had been given up that “we were stunned,” said Calvin Welch, who joined the coalition on behalf of the Council of Community Housing Organizations. “We met with [Mayor Ed Lee] and told him, this is absolutely unacceptable.”

But the mayor wasn’t willing to address their concerns at that time. When the deal failed to win approval after a series of hearings at the Board of Supervisors, however, “the unacceptable deal that the mayor created melted in the sun of full disclosure,” Welch said.

That plan would have allowed St. Luke’s Hospital, a critically important facility for low-income patients, to shrink to just 80 beds with no guarantee that it would stay open in the long run. CPMC’s commitment to providing charitable care to the uninsured was disappointingly low. And while the project was expected to create 1,500 permanent jobs in San Francisco, the deal only guaranteed that 5 percent of those positions would go to existing San Francisco residents.

Enter the movers and shakers with San Franciscans for Healthcare, Housing, Jobs, and Justice. The coalition took its place at the negotiating table, along with CPMC, a mediator, and an unlikely trio of supervisors that included Board President David Chiu and Sups. David Campos and Mark Farrell. Over several months, the coalition put in some serious time and energy to push for a more equitable outcome.

“We pushed so hard for a smaller Cathedral Hill [Hospital] and a larger St. Luke’s,” Welch said, describing their strategy to safeguard against the closure of St. Luke’s. They also pushed for CPMC to make a better funding contribution toward affordable housing, a stronger guarantee for hiring San Franciscans at the new medical center, and improvements to transit and pedestrian safety measures as conditions of the deal.

Under the terms that were ultimately approved, St. Luke’s will remain a full-service hospital, and CPMC will commit to providing services to 30,000 “charity care” patients and 5,400 Medi-Cal patients per year.

CPMC also agreed to contribute $36.5 million to the city’s affordable housing fund, and promised to pay $4.1 million to replace homes it displaces on Cathedral Hill. Under the revised deal, 30 percent of construction jobs and 40 percent of permanent entry-level positions in the new facilities would be promised to San Francisco residents.

One of the greatest victories of all, Welch said, was how well coalition members worked together. “This was the most straight-up equal collaboration with labor and community people, equally supporting one another, that I’ve ever been involved with,” Welch said. Even though they were motivated to participate by different sets of concerns, the two sides remained mutually supportive, Welch said. During the long, grueling hearings, “The nurses never left,” he noted in amazement. “The nurses stuck around for all the community stuff.”

Mayor Lee responds to political furor with more funding to fight evictions

We’re not sure whether it was the high-profile recent protests against the eviction of the Lee family, our well-read “City Hall must address rising rents” editorial or eviction and gentrification coverage last week, our earlier focus on record eviction rates, or just the growing view that City Hall is too friendly to landlords and neglectful of tenants, but the Mayor’s Office has finally awoken to the biggest issue facing this city.

With skyrocketing rents — and with increasingly common efforts by the landlords of rent-controlled apartments to take advantage of that market by forcing out their tenants — Mayor Lee this afternoon announced that he’s tripling funding to fight illegal Ellis Act evictions, making populist statements along the way.

Now, spending an additional $700,000 to fight greedy, deep-pocketed landlords is not exactly going to change the playing field, but it’s a nice gesture and an indicator that Mayor Lee is starting to notice the problem. Hopefully, with pressure by progressive politicians and activists, this will be just the first of many such actions.

MAYOR LEE ANNOUNCES ADDITIONAL RESOURCES FOR EVICTION PREVENTION IN SAN FRANCISCO

San Francisco to increase resources to support residents and families affected by illegal Ellis Act evictions and releases Eviction Prevention Funding from Housing Trust Fund

San Francisco, CA—Mayor Edwin M. Lee announced San Francisco will triple the amount of funding to prevent illegal Ellis Act evictions and that the City will release $700,000 in funding for other eviction prevention services from the Housing Trust Fund.

“San Francisco must remain a viable place to live and work for people at all levels of the economic spectrum,” said Mayor Lee. “That’s why I am providing additional resources to stop unlawful evictions and provide tenant counseling for our residents, so that San Francisco remains a City for the 100 percent.”

The Human Services Agency (HSA) currently provides nearly $8 million in homeless prevention and eviction defense services, an increase of $1.3 million from last year’s budget. In this year’s budget, the City was providing nearly $125,000 to fund free legal advice and represent 55 San Francisco families who have been affected by illegal Ellis Act eviction threats. Today, Mayor Lee tripled the amount of funding with an additional $250,000, which will immediately be available to eligible organizations that provide Ellis Act prevention legal work and will help more families and people at all levels of the economic spectrum remain in San Francisco.

“Providing resources to stop unlawful evictions has proven to be one of the most effective strategies to prevent displacement and homelessness in our City,” said Trent Rhorer, Director of the San Francisco Human Services Agency. “This additional $250,000 will help keep San Francisco families in their homes.”

The Mayor’s Office of Housing will also provide $700,000, from the Affordable Housing Trust Fund, to fund tenant counseling services. This is a 63 percent increase in funding and brings the total amount to more than $2.3 million in eviction prevention services from the Mayor’s Office of Housing. These additional resources will be distributed to community based organizations specifically expanding legal representation for individuals facing eviction; rental assistance to individuals and families who are currently homeless or are struggling to keep their current rental housing; and to provide outreach to San Franciscans to better inform them about their legal rights.

The Mayor’s Office of Housing has prioritized eviction prevention services and funds activities including legal services, tenant counseling, rental assistance, move-in assistance, know your rights trainings, and other types of tenant support.  Services are offered through a diverse group of community based organizations that reach San Francisco’s many communities including seniors, people with disabilities, immigrants, the homeless and families.

The HSA will issue an ‘Invitation to Bid’ this week so eligible organizations can apply and use the HSA funding to expand their legal services in order for them to be available to vulnerable tenants within 30 days. It is anticipated that the additional HSA funds will help at least 150 households receive legal advice and representation.

SF supervisors approve policy of denying federal immigration hold requests

The San Francisco Board of Supervisors Chambers erupted in raucous celebration and chants of “Si se puede!” this afternoon as the board gave unanimous approval to a new city policy of refusing most detention hold requests from US Immigration and Customs Enforcement, which has used its controversial Secure Communities program to learn when undocumented immigrants end up in local jails and to have them held for deportation.

The legislation by Sup. John Avalos is intended to build trust between law enforcement and immigrants, which can be reluctant to report crimes such a domestic violence or buglaries for fear of deportation. “People who have to deal with the devastation that Secure Communities causes, they’re the ones who brought this forward,” Avalos said.

Those advocates had to wait a week for this momentus occasion because of amendments that were introduced last week, prompted by opposition to the measure by Mayor Ed Lee and Police Chief Greg Suhr, who expressed concern that it would shield violent felons from deportation.

Those amendments were introduced by Sup. Jane Kim, who had supported the original measure without them but sought to broaden support for the measure. Her amendments make exceptions for those convicted of violent felonies, sex trafficking, child molestation, and use of a gun in commission of a felony, although they call for police to consider factors such as a dependent child before allowing ICE to take custody of an undocumented immigrant.

Avalos opposed the amendments, saying “any carve-outs deter the victims of crimes from reaching out to law enforcement.” The amendments were also criticized by Sup. David Campos, who called them “counterproductive to public safety.” But both accepted them and called the measure an important victory.

“What’s happening in this chamber is a victory for the immigrant communities of San Francisco and all communities in San Francisco,” Campos said in English before repeating it in Spanish. “Let’s emphasize the common ground that we have found.”

The ordinance is set to receive final approval next week when it’s heard on second reading. Sheriff Ross Mirkarimi — who has supported the legislation since its inception and who will oversee its implementation in the jail — said his office had just received the latest amendments and is still reviewing them.

“It’s the unintended consequences that bring me here before you today,” Mirkarimi told his former colleagues at the board, saying he wants to make sure the new policy is clear enough so that even deputies working in the middle of the night would know how to handle ICE requests. “Changes in the legislation do pose some operational concerns.”

Mirkarimi had already instituted policies of resisting many federal immigration hold requests, joining with San Jose, Berkeley, and other cities who oppose the S-Comm program, and this ordinance broadened and codified those policies.

The legislation was strongly supported by the city’s Domestic Violence Consortium, representing an ironic turn of events when Mayor Lee — who waged a protracted and unsuccessful campaign to remove Sheriff Mirkarimi from office for grabbing his wife’s arm last year — threatened to veto it. Avalos also placed second in a crowded field of candidates when Lee was elected mayor in 2011.

It was Lee’s veto threat that ultimately weakened the legislation, a move opposed by activists who work on domestic violence issues. But Kim made clear that despite her amendments, she strongly opposes S-Comm and its local impacts.

“We believe the S-Comm program is deeply flawed,” Kim said, telling the story of a constituent who feared calling the police after their home had been burglarized. “No one should fear calling the police when they need help.”  

Is Art Torres helping PG&E, helping his son’s political career, or both?

As I’ve been reporting on how CleanPowerSF is being blocked by Mayor Ed Lee and his political appointees on the San Francisco Public Utilities Commission, one piece of the puzzle that I couldn’t quite figure out was why SFPUC President Art Torres took the position he did, offering little public explanation for his stance.

“His opposition to the rate vote was strange because he didn’t give clear reasons,” Eric Brooks, who has been led the grassroots campaign in support of CleanPowerSF, told us. Torres also hasn’t returned Guardian calls on the issue, and he refused a formal request from Sup. John Avalos to explain his position.

As a former state senator and longtime former chair of the California Democratic Party, Torres certainly has connections to Pacific Gas & Electric and the array of politicians that support it, include Willie Brown. But that just didn’t seem like enough for a senior statesman with a decent environmental record to sabotage San Francisco’s only plan for building renewable energy projects.

But some of my political sources have clued me into another possible motive, and it seems to make sense. Art Torres’ son is Joaquin Torres, who works in the Mayor’s Office and who Lee in February appointed to the Housing Commission, where Torres now serves as president.

And here’s the kicker: those sources also say that Joaquin Torres has already started running for the District 9 seat on the Board of Supervisors, which is now held by Sup. David Campos, who is running for Tom Ammiano’s seat in the California Assembly. And if Campos wins that race next year, Mayor Lee will get to fill it, possibly naming Torres to one of the most progressive seats in the city.

So dad gets to score political points with some powerful friends, and help launch his son’s political career in the process. These motives are beginning to add up.

Joaquin Torres is now deputy director of the San Francisco Office of Economic and Workforce Development, “where he leads Mayor Lee’s Invest In Neighborhoods Initiative to leverage City resources across city departments to maximize positive economic and social impact in low-moderate income neighborhoods and throughout San Francisco’s commercial corridors,” the Mayor’s Office wrote in February when Torres got appointed to the Housing Commission.

Sounds like the perfect job for someone being groomed for the Board of Supervisors, where he could have a serious impact on this city’s political dynamic, tipping policies in the neoliberal to moderate direction of expanding corporate welfare programs and speeding up gentrification.

Neither Torres has returned our calls, but I’ll update this post when and if they do. And while this is clearly just political speculation and conjecture, I have a feeling that I’m onto something here. So remember where you read it first.  

Challenge Mayor Lee and his lies

EDITORIAL In the long history of San Francisco political corruption caused by Pacific Gas & Electric’s willingness to do and spend whatever it takes to hold onto the energy monopoly that it illegally obtained generations ago, in violation of the federal Raker Act, there have been countless ugly and shameful episodes, many of them chronicled in the pages of the Bay Guardian.

Mayor Ed Lee’s misleading Sept. 10 testimony to the Board of Supervisors, where he deliberately distorted CleanPowerSF and defended the dubious actions of his appointees to kill the program, ranks right up there with some of the worst episodes (see “Power struggle,” page 12). If there were any doubts about Lee’s lack of political integrity and independence, about his unwillingness stand up to his corporate benefactors on the behalf of the people he was elected to serve, this appalling performance should settle them.

It was bad enough when PG&E used money from San Francisco ratepayers to bury public power advocates under an avalanche of lies, fear-mongering, and the testimony of paid political allies every election when its monopoly was being challenged, making it virtually impossible to have an honest conversation about the city’s energy and environmental needs.

But now that advocates for consumer choice and renewable energy have spent more than a decade developing a program that doesn’t require a popular vote, is competitive with PG&E’s rates, would create city-owned green energy projects serving residents for generations to come, and which was approved by a veto-proof majority on the Board of Supervisors, Mayor Lee has stooped to new lows in a desperate and transparent ploy to stop it.

Once again, as he did during his rash decision to remove Sheriff Ross Mirkarimi from office before even investigating his most serious official misconduct allegations, Mayor Lee has blithely created what Sen. Mark Leno calls a “Charter crisis.” Then, it was over the question of when one elected official should remove another; now, it is whether a trio of mayoral appointees can usurp the authority of the elected Board of Supervisors, the top policymaking body under the City Charter.

Relying on tortured logic and Clinton-esque legalese backflips doesn’t justify the SFPUC commissioners refusal to do their jobs — and it would be deemed official misconduct by a less corrupt mayor. But this mayor sees his job as simply carrying water for the people who put him there, whether that be Willie Brown and his longtime client PG&E, or venture capital Ron Conway and the companies that Lee is heaping with unprecedented tax breaks (see “Corporate welfare boom,” page 14). Please, isn’t there someone out there willing to challenge this corruption and run for mayor? This city, and the future generations living in the warming world we’re creating, deserve better.

Mayor Lee distorts reality in defending CleanPowerSF obstruction by his appointees

Mayor Ed Lee yesterday answered a series of five questions from the Board of Supervisors about CleanPowerSF, the renewable energy program it approved last year on a veto-proof 8-3 vote, but which three of Lee’s appointees on the San Francisco Public Utilities Commission are now blocking.

Lee reaffirmed his opposition to the program and support for the three commissioners who are refusing to approve a maximum rate for the program, while making a series of statements that were misleading, contradictory, and, according to Sup. John Avalos, some outright falsehoods.

CleanPowerSF would group tens of thousands of city residents into a renewable energy buying pool, a system called Community Choice Aggregation authorized by state legislation, which would compete against Pacific Gas & Electric’s illegal local monopoly. Initally, the energy would be purchased under a contract with Shell Energy, but the main goal of the program is to build city-owned renewable energy facilities by issuing revenue bonds supported by the program’s ratepayers.

Yet the program Lee described has little resemblance to CleanPowerSF — and his statements of support for the concept belie his longstanding opposition to the program and support for PG&E, whose union is leading the campaign to kill CleanPowerSF.

“I know that many members of the Board of Supervisors are upset,” Lee began in his first answer to similar questions posed by Sups. Eric Mar, David Chiu, London Breed, David Campos, and John Avalos, who all represent the odd-numbered districts whose turn it was to submit questions to the mayor for this month’s appearance.

Lee then explained that one of the duties of  the SFPUC is to protect ratepayers, which he called “the overriding concern they have when faced with any issue,” adding that, “The commission ultimately decided that the rate wasn’t a fair rate.”

Ironically, the top rate that the commission is being asked to approve in order to finally launch CleanPowerSF was just 11.5 cents per kilowatt-hour, only slightly more than current PG&E rates and a substantial reduction from the rate that was discussed last year when supervisors approved the program.

PG&E, Lee, and other critics of the program had attacked its high cost, so SFPUC staffers tweaked the program to allow the initial use of Renewable Energy Credits, which support the creation of renewable energy projects, rather than being purely juice directly from solar, wind, and other renewable sources, which is more expensive.

So Lee criticized that change as a departure from what the board approved last year, telling the supervisors that the program should be at least “95 percent renewable on day one,” saying that, “This is what a green power program should look like.”

Yet when it did look like that, Lee opposed it, something he didn’t mention yesterday. And yet he still made the argument that the SFPUC was simply exercising its fiduciary responsibility in blocking a program that has gotten cheaper than when the board approved it.

“The San Francisco Public Utilities Commission did its job in protecting ratepayers,” Lee said. “I agree with the majority of the PUC.”

So, on one hand, Lee said that CleanPowerSF has “gotten progressively more expensive as time goes on,” citing statements made years ago about the goal of trying to meet-or-beat PG&E’s rates, which have been subsidized by taxpayers over the years.

And when the program then got close to matching those rates, he criticized the use of RECs to get there, saying the climate change benefits “need to be real and tangible and not based on vague promises.”

Yet even city-commissioned studies have shown that San Francisco won’t meet its own greenhouse gas reduction goals without substantially changing the energy portfolio of city residents, and CleanPowerSF is the only plan on the table to get there, except for PG&E’s vague promises to offer more renewable energy in the future.

While Lee touted city efforts to improve the energy efficiency of commercial buildings and the recent launch of a regional bike share program — neither of which will come close to meeting city climate change goals — even he acknowledged the “need to expand our in-city renewable energy generation,” citing the $4 million SolarSF as an example.

But Lee never made reference to CleanPowerSF’s plan to build up to $1 billion in renewable energy projects whose impacts would be far more impactful. Instead, he said the program “creates no local jobs,” which wouldn’t be true during the buildout phase.

While praising PG&E, Lee also glossed over the fact that a majority of supervisors still support CleanPowerSF, and that the SFPUC vote was supposed to be on the rate and not these ancillary issues, raising fundamental democratic issues when three mayoral appointees can override the decision of elected supervisors who represent all city residents.

“When a final project is so vastly different than the original intent, the San Francisco Public Utilities Commission has to intervene,” Lee said.

Avalos called many of Lee’s statements “lies,” so I followed Mayor Lee back to his office after the hearing and we had the following conversation as several reporters from other media outlets listened in:   

SFBG: Supervisor Avalos just said that you’ve made a number of statements that are not factually accurate, and certainly misleading, including saying that the program has changed substantially. Given that you opposed the program initially, and you seem to make statements that criticize those changes, and clearly the majority still supports it, how can you make the argument that the PUC is acting against it because the program has changed?

Mayor Lee: Well, you know, I know that elements of this are somewhat complicated cause you have to actually read a lot of volumes of materials to understand the choice aggregation program, cause it has those three aspects and I would….

SFBG: As guidelines, not as rates….

Mayor Lee: I would point to those numbers that were discussed at the board and presented to the [SF] Public Utilities Commission, because that’s what I’m quoting from. I’m taking it, not from even verbiage, I’m taking it exactly from facts that were presented at the commission at the Board of Supervisors and I specifically lifted quotes from the board about their comments about local jobs and all the other things, so, I don’t think I’m inaccurate at all. I think I’m actually quite on point.

SFBG: But the rates have come down from when they approved it and you made it sound like the rates have gone up.

Mayor Lee: The rates were up and they came down in trade off with less green.

SFBG: Right…

Mayor Lee: That’s about the point I was trying to make is that we wanted these other goals to happen and they couldn’t happen cause people were trading off things in order to set the rates and that was going to become a bigger and bigger gap as to what the original goals were. That’s the way…

SFBG: But the board clearly wants this program. Why, as a matter of policy, as a matter of city procedure, why isn’t the elected body the one to make this decision, instead of your appointees?

Mayor Lee: Well, I think that’s the whole reason why they presented it to the Public Utilities Commission. They’re charter mandated to set these rates. It’s not just an automatic acceptance of what the board says. They also independently review what the board has said. And in their independent review, they said they had gone well beyond what they stated their goals were and so they couldn’t set the rates and still honor all the goals that the board was suggesting.

SFBG: But those rates are less than what the Board has approved. How can they be exercising fiscal oversight… I mean, it doesn’t make any sense.

Mayor Lee: I think we have a big disagreement there. They’re mandated by the charter to set those rates responsibly, not just to follow what the board has stated and so, in their independent review, they went and reviewed all the goals that the board has said and said ‘This is not the program that they have stated should be fulfilled.’

SFBG: Even though the majority of the Board of Supervisors disagree with that statement that you just made?

Mayor Lee: Well, you know, then again, are we not respecting peoples’ right to disagree over what is being done here?

SFBG: But your argument that the program changed from what they approved, a  majority is saying ‘that’s not true,’ that you’re misrepresenting that.

Mayor Lee: No, I don’t think that I’m misrepresenting that. I disagree with that.

SFBG: A majority of the Board of Supervisors who approved it says you are.

Mayor: Well, I disagree with that assessment.

 

 

 

Supervisors to grill Mayor Lee over CleanPowerSF sabotage

Mayor Ed Lee will be on the hot seat for his unqualified support of Pacific Gas & Electric Co. and his related opposition to the CleanPowerSF renewable energy program, which his appointees to the San Francisco Public Utilities Commission are trying to sabotage, when he shows up for the monthly mayoral question time at the Board of Supervisors meeting on Tuesday.

Hopefully the boring, scripted question time format that Lee created in collaboration with Board President David Chiu will finally give way to what the voters intended when they required the mayor to engage with the legislative branch: an actual, substantive, back-and-forth policy discussion meant to illuminate issues of public concern.

Because that’s what’s needed on this important issue. After more than a decade in the making, the board last year cast a historic vote to create the project on a veto-proof 8-3 vote. But the SFPUC is now refusing to set the maximum rate for the program, which should be a fairly technical and pro forma action, instead raising unrelated issues that the supervisors have already considered. In other words, unelected mayoral appointees have decided to veto a hard-won democratic gain, creating something akin to a constitutional crisis in a city that values public process and input. 

So for the first time ever, all the of the supervisors scheduled to ask questions (it rotates because odd- and even-numbered districts each month) have focused various aspects of a single important issue. Even though Lee has mastered the politicians’ dark art of speaking without saying anything, this one should still be a doozy as supervisors ask the following questions:

1. Mayor Lee – As you know, San Francisco has set ambitious goals to combat climate change. In many ways, the City is making great strides in this direction, from increasing bicycling, to pursuing zero waste goals, to hiring a new, excellent environmental policy advisor in Rodger Kim who has a strong background in environmental justice and community engagement. However, the Public Utilities Commission has repeatedly failed to set rates for CleanPowerSF, the most impactful local proposal yet designed to curb carbon emission. This program was adopted by the Board of Supervisors, the legislative body of the City. However, there are some allegations that your office is stalling its implementation. What specifically are you doing, as the City’s head executive, to implement this policy in a timely fashion? (Supervisor Mar, District 1)

2. Mr. Mayor, can you please outline your objections to the CleanPowerSF program as approved last year on an vote 8-3 by the Board of Supervisors? (Supervisor Chiu, District 3)

3. Recognizing the constraints imposed by state law, particularly with respect to opt-out provisions, how would a clean power program need to be structured in order for you to support it? Are you willing to work with the Board of Supervisors, and have your staff and commissioners work with the Board of Supervisors, to revise CleanPowerSF so that you can support it? Can we come to the table and make clean power a reality without any further delay? (Supervisor Breed, District 5)

4. The Board of Supervisors has been very supportive of CleanPowerSF. Do you think it is appropriate for a City Commission to go against the policy the Board of Supervisors set when it approved CleanPowerSF? (Supervisor Campos, District 9)

5. Days after the one-year anniversary of the 2010 PG&E San Bruno pipeline explosion, you called PG&E a “great local corporation” and a “great company that gets it.” However, the examples of PG&E’s immoral, illegal, and greedy behavior are legion:

– PG&E avoided admitting fault in the San Bruno explosion, failed to cooperate with the investigation, fought against paying a fair fine, and hopes to make ratepayers pay for the fine.

– PG&E’s current electric mix is only 20% California-certified renewable.

– Outages of PG&E-owned streetlights have increased over 400% in recent years, and PG&E wants to increase by $600,000 a year the amount it charges the City for streetlight maintenance without committing to improved service.

– Despite the fact that PG&E already has some of the highest electric rates in the country, PG&E is seeking to further increase rates in each of the next three years.

– While PG&E has proposed a new Green Tariff program, it remains only a vague proposal and there is no guarantee that it will ever be implemented.

A high-profile local civil rights ordinance passed last year to shine light on the San Francisco Police Department’s joint activities with the FBI has been undermined by the SFPD’s refusal to disclose its surveillance activities. This comes at a time when the public is learning more than ever about the federal government’s intrusion into the privacy of law-abiding US citizens.

In May 2012, the Board of Supervisors unanimously passed the Safe San Francisco Civil Rights Ordinance, which Mayor Ed Lee signed in a photo-op ceremony with Police Chief Greg Suhr and the activists who supported it. They claimed the board’s passage of the ordinance ushered in a new era of transparency over the SFPD’s previously secretive work with the FBI-led Joint Terrorism Task Force.

“The ordinance basically requires three things,” Nasrina Bargzie, a civil rights attorney at the Asian Law Caucus who worked on the measure, told the Bay Guardian. “The first part requires that the Police Department work with the JTTF has to follow the California constitutional rights of privacy, so they’re not following the lax standards of the [US] Department of Justice. The second part is that they can no longer enter into any secret agreements with the FBI; it has to go before the Police Commission in a public setting. The final part of the ordinance exists to make sure the rules are being followed, so there is a requirement for a yearly report.”

At the time of its passage, activists told the Guardian that the ordinance was only as strong as the SFPD’s willingness to disclose its activities (see “Mayor Lee signs watered-down limits on SFPD spying,” 5/9/12). But the SFPD’s refusal to disclose even minimal, basic information calls into question the ordinance’s value.

After the release of multiple reports earlier this year that activists called inadequate, Suhr is now maintaining silence regarding the JTTF, while claiming the department is in full compliance with the ordinance. According to Bargzie, Suhr told her the FBI is barring him from disclosing the requested information.

Following multiple efforts by the Guardian to get a comment out of SFPD about the ordinance and whether the department was indeed taking a subservient role to the FBI, SFPD Sgt. Dennis Toomer told us, “We’re not talking about that at all.”

LACK OF RESPONSE

Activists have sparred with Chief Suhr over implementation of the ordinance and its required annual report since at least the beginning of 2013.

Deputy Chief John Loftus presented the first report to the Police Commission on Jan. 23, which claimed the SFPD was in “full compliance” with the ordinance without providing any details. Activists and the public quickly demanded a real response.

“The commission presented this short oral report, which was a little short of two minutes long,” Bargzie told us. “There was no data that we were not already aware of. It was just basic statements claiming that they were complying with the ordinance.”

Suhr apologized for the omissions while stating his department was still in compliance with the ordinance’s guidelines, pledging to be more forthcoming. At this time, SFPD Sgt. Michael Andraychak told the Guardian: “The Chief’s Office is in the process of scheduling meetings with Nasrina Bargzie [of the Asian Law Caucus] to develop a report with more detail so those concerned and the public can be as informed as possible. Chief Suhr is committed to remain in compliance with the ordinance.”

The Coalition for Safe San Francisco, an activist group consisting of Muslim Legal Fund of America, Asian Law Caucus, and dozens of other groups, met with Suhr to discuss setting up a template for the reports.

Suhr then released a second report, which contained more relevant information, stating that SFPD officers did not act as informants in 2012 and three full-time SFPD officers were assigned to the JTTF.

But the report still omitted key oversight information, such as whether any prosecutions resulted from JTTF and SFPD investigations, which would allow the Muslim Legal Fund of America and other groups to determine who the SFPD is arresting and why.

Last year, Suhr told a San Francisco Examiner reporter that his officers followed up on 2,000 tips regarding counterterrorism activities. However, this information curiously did not make it into the official report.

“We contacted the chief to let him know we were not okay with this. We had another meeting with him and he said he’d think about it and get back to us and now he is claiming he cannot honor a basic component of the ordinance,” Bargzie told us. “He asserts in writing this is because the FBI will not let him share the basic information.”

WEAKENED LEGISLATION

The weak efforts behind the implementation of the SSFCRO date back to Mayor Lee’s veto of a stronger ordinance in April 2012, which would have codified privacy protections and given the Police Commission more power to stop FBI-SFPD activities that did not comply with Department General Order (DGO) 8.10, the 1990 policy aimed at protecting First Amendment activities. After Lee’s veto, the Board of Supervisors passed a weaker version. Both were sponsored by Sup. Jane Kim.

John Crew, a former police practices expert with the Northern California American Civil Liberties Union, raised concerns to the Guardian about the weakened legislation. “It is a step in the right direction, there’s no doubt it’s progress,” Crew told us at the time. “But whether it’s real progress depends on the implementation. Ultimately, it will come down to political will at the Police Commission to enforce privacy protections.”

Much of the ordinance’s failure stems from the apparent lack of real intent to disclose what the activists sought. Critics painted the SSFCRO signing ceremony as a hollow symbolic act, a way for Mayor Lee and Chief Suhr to publicly promote civil rights and progressive ideals with an ordinance they purposefully weakened.

“My sense is that [the SFPD] is not taking this seriously,” Bargzie told us. “I think they probably believe that they are providing as much information as the FBI will let them and Chief Suhr thinks it’s fine that the FBI can tell him to share what they tell him to.”

The lack of transparency regarding the JTTF’s work with the SFPD requires the public to trust the federal government to safeguard civil liberties. But in the wake of whistleblower Edward Snowden’s leak exposing the expansive surveillance system by the National Security Agency and the SFPD’s notorious history of illegal surveillance and racial profiling, the public has little reason to trust the authorities.

HISTORY OF SPYING
The passage of the SSFCRO is the latest effort to counter a long history of racial profiling, spying on radical political groups, and other constitutional violations, episodes that have been followed by progressive reforms in San Francisco.
Prior to the passage of DGO 8.10 in 1990, the SFPD notoriously participated in the surveillance of non-criminal, pacifist political organizations. During the 1984 Democratic National Convention, the SFPD carried out surveillance on law-abiding organizations and, throughout the 1980s, it created files on civil, labor, and special interest groups in the Bay Area, revelations that led to the adoption of DGO 8.10.
But even after that, disclosures surfaced showing that the SFPD was blatantly violating its own rules. They included then-Police Chief Tony Ribera admitting that files on non-criminal political activity were not destroyed (as required by the ’90s reforms), the selling of confidential intelligence material to foreign governments and private entities, and the actions of SFPD Intelligence Officer Tom Gerad, who informed on local political groups for the FBI.
In the subsequent years following the Gerad scandal, San Francisco sought to strengthen DGO 8.10, requiring more transparency and oversight. But this progress was undercut in 2007 when the SFPD secretly signed a secret JTTF Memorandum of Understanding (MOU) undermining DGO 8.10.
San Francisco’s Human Rights Commission held hearings in which the community voiced concerns over illegal police and federal surveillance. In response, the SFPD said they were unable to discuss arrangements with the JTTF without the permission of the FBI.
In 2011, the previously secret MOU was unearthed by the ACLU (see “Spies in blue,” 4/26/11), prompting Suhr to issue Bureau Order #2011-07, which reinforced that SFPD personnel were under the jurisdiction of local and state privacy protections and did not spy on law-abiding groups. SFPD Public Information Officer Albie Esparza said the order reversed the language of the 2007 memo.
Part of Suhr’s amendment to SFPD policy at the time included the necessity of a predicate offense in all SFPD investigations. Thus, the SFPD could not investigate or spy on those who were not suspected of violating the California Penal Code or federal law.
Activists wanted those protections enshrined in city law, which resulted in last’s vetoed ordinance and passage of the watered down Safe San Francisco Civil Rights Ordinance in 2012, which activists now say they feel duped by.
“We have been extremely disappointed at the lack of information that has been included in the reports,” Summer K. Hararah, Regional Director for the Greater San Francisco Area Muslim Legal Fund of America told us. “If the SFPD is going to violate rights of Arab-Americans, the police chief has a responsibility to stand up to the FBI.”

POST 9/11 WORLD
Lax federal guidelines for counterterrorism have been building since the Bush Administration began implementing emergency measures after 9/11 terrorist attacks in 2001. In San Francisco’s case, the FBI has subjected local law enforcement to these rules.
Since 9/11, both the ACLU of Northern California and the Human Rights Commission have publicized cases of racial profiling and surveillance of pacifist, non-criminal Muslim and Middle-Eastern groups in San Francisco. A 2007 FBI memorandum illustrated a prominent instance of this profiling in which FBI agents attended Ramadan Iftar dinners in San Francisco purportedly as part of the FBI’s mosque outreach program. Under this guise, the agents collected data on certain attendants, including names, the content of conversations, and other information covered by the First Amendment. According to the FBI Domestic Investigations and Operations Guide, the JTTF is permitted to conduct surveillance of this nature, by identifying “locations of concentrated ethnic communities in the Field Office’s domain, if these locations will reasonably aid in the analysis of the potential threats and vulnerabilities, and, overall assist domain awareness for the purpose of performing intelligence analysis.” These policies directly contradict SSFCO, DGO 8.10, and the California Constitution’s privacy protections. In Portland, Ore., the local government successfully fought this issue by bifurcating local law enforcement from the JTTF after the public and the ACLU raised concerns over similar constitutional violations and racial profiling. This Portland model is now a precedent for activist groups nationwide, seeking to end the lack of oversight permeating their local police departments. “Portland has been a great model,” Hararah told us. “When the FBI began to interview Muslim men in mass after 9/11, Portland was one of the few that said ‘absolutely not.'” But in San Francisco, Lee (whose office also didn’t respond to our request for comment) and Suhr’s symbolic promotion of civil rights has diminished into a case of them basically bullshitting the public. “Civil rights is not a symbolic issue,” Hararah told us. “The mayor backed this legislation and we want to see that the commitment is put forth with global insurance. The first step is having info about what the JTTF is doing to be sure it abides by human rights protections and is appropriate.”

Protect local power and control

EDITORIAL There’s a growing stench of political corruption — or, at the very least, hidden agendas aimed at subverting popular will in favor of entrenched corporate interests — emanating from the Mayor’s Office these days. And it’s undermining projects and institutions that are vital to the future of San Francisco.

In the last week, a pair of important developments illuminated the shady way business gets done in San Francisco. The first instance concerned City College of San Francisco, which had its accreditation rashly revoked last month, prompting Mayor Ed Lee to enthusiastically support the disbanding of the locally elected Board of Trustees and the takeover of City College by state-appointed outsiders bent on shutting down community-based facilities and classes.

While Lee and the San Francisco Chronicle have been cheerleading this loss of local control and the corporatist agenda behind it — CCSF was criticized for resisting the narrowing of its mission to focus on job training and college prep — we at the Guardian have questioned this process and the motives behind it.

In a cover story (“Who killed City College?” July 9), editorial (“Why democracy matters,” July 23), and other coverage, we’ve highlighted how the attack on CCSF is part of national movement to focus schools on job training rather than broad-based education, and questioned the haste with which CCSF’s local leadership was usurped.

Critics mocked these concerns, as they did those of the California Federation of Teachers, which formally challenged the actions by the Accrediting Commission of Community and Junior Colleges, with Lee and others saying that we need to just accept the death threats against CCSF and do whatever these outsiders are asking.

So on Aug. 13, when the US Department of Education sustained the CFT appeal and found the ACCJC in violation of federal regulations and its own internal standards in its approach to City College, it validated our concerns and called into question Lee’s hair-trigger abandonment of City College’s local leaders.

Frankly, we’re puzzled by Lee’s approach to City College — from his appointment of right-wing ideologue Rodrigo Santos as a trustee last year (who subsequently got trounced in the election) to his resistance to helping the college before the state takeover — but we suspect it’s connected to Lee’s focus on “jobs, jobs, jobs” to the exclusion of other issues and values.

But Lee only counts private sector jobs, not those created to serve the public interest like the thousands of jobs that would be created by CleanPowerSF, a program that Lee opposes and that his appointees to the SF Public Utilities Commission are actively subverting.

As we report in this issue, CleanPowerSF is a renewable energy program approved last year by a veto-proof majority on the Board of Supervisors, but it’s being blocked by the SFPUC’s refusal to approve the rates and sign the contracts, with commissioners raising concerns that go well beyond their purview at this point.

It’s time for Mayor Lee to start serving the people of San Francisco instead of the corporate titans and political benefactors who elevated this loyal career bureaucrat into the big chair in Room 200.

 

Get tough with defiant disrupters

EDITORIAL It may sometimes seem like we at the Bay Guardian don’t like the technology industry, but nothing could be further from the truth. We tweet, click, post, and share, playing with all the hot new tech toys that spring from the innovative minds of Bay Area residents. This is an important sector of the local economy, one that often empowers people who were just getting by to remain in expensive San Francisco.

Yes, we do regularly criticize tech (and some of its biggest neoliberal cheerleaders in City Hall), as we do to Airbnb, Lyft, and other so-called “shareable economy” companies in this issue. But that’s only because we strongly believe in open and transparent discussions about public policy and the needs of city residents.

And frankly, that’s not happening these days.

Instead of engaging directly and honestly with the people and our elected representatives, Airbnb has chosen to duck its obligations to the city of its birth and dodge attempts to create a public dialogue about its dangerously flawed business model. Same thing with Lyft, another company that acts as if it’s entitled to undermine civic institutions without so much as a public conversation first.

Yes, these companies have come up with cool ideas that have become popular with Bay Area residents. In a city where it was tough to find a cab on Saturday nights, Lyft made it easier to find rides and allowed people to make some extra cash off their cars. Airbnb was also a great idea that makes travel cheaper and more personal.

The beauty of these ideas is their simplicity — but that is also their main flaw, because San Francisco isn’t a simple city. It’s a complex, dynamic city with difficult landlord-tenant dynamics, and a congested city that tries to achieve the right balance of cabs on the roadways, both systems that are the products of decades-long struggles that have spawned reams of regulations.

These tech-savvy fortune hunters, who don’t understand or appreciate that history, think it’s enough to have a good idea and some rich venture capitalists willing to back it. They espouse vaguely libertarian ideas about “disruptive” technologies empowering people, but then they wait for government officials to solve the problems with their business models, raking in millions of dollars in profits in the meantime and delaying their day of public reckoning as long as possible.

For example, in a May interview on KQED’s Forum, Airbnb’s David Hantman was asked why the company was defying a city ruling that it must pay the transient occupancy tax, he said they were waiting for the city to adopt a new regulatory structure first.

That’s not an acceptable or defensible position, and it is only continuing because Mayor Ed Lee has publicly supported the company’s defiance of city law and rulings. Mr. Mayor, if these are the types of “jobs” you’re creating — part time jobs with no benefits in an underground economy that cannibalizes other industries, breaks city laws, and won’t pay local taxes — then this city is in real trouble.

We’re happy to see Board President David Chiu trying to solve Airbnb’s problems, but he needs the support of other top city officials who are willing to put pressure on the company to bargain in good faith. And yes, we’re talking to Mayor Lee, Tax Collector Jose Cisneros, and City Attorney Dennis Herrera, among others.

If you make the city appear impotent to enforce its own laws or too willing to go easy on wealthy corporations, it will only embolden more young opportunists to disrupt the city’s regulatory authority and its social fabric. You work for us, not the venture capitalists, and it’s time to show some spine.

Today marks 1,575 days since concession workers at AT&T Park have had a raise, during which time the San Francisco Giants have been fabulously successful, both on and off the playing field.

The 750 workers represented by UNITE-HERE Local 2 are currently involved in frustrating and fruitless negotiations with their employer, Centerplate, a South Carolina-based food service company contracted by the Giants to sell beer, garlic fries, and other overpriced consumables at games.

The Giants and its front office seem fairly unconcerned about the plight of workers who proudly don the team’s logo and pad its revenues. Not a single concession worker that we interviewed for this article said that they work for Centerplate — each of them said that they work for the Giants.

Since the last contract expired in March 2010, the Giants have won two World Series championships, raised the average ticket price by 20 percent, and have seen the value of the team shoot up by $223 million. The only thing that hasn’t improved are the wages of the concession workers.

Cashiers currently make $16.40 per hour, in-seat runners make $13.40, and some entry-level workers make just $10.45, which is actually less the city’s minimum wage. That’s only legal because those workers were under contract for $10.45 per hour when the wage increased to $10.55 at the beginning of this year. And Centerplate won’t even let Giants workers have a tip jar to augment their substandard wages.

Local 2 reports that revenue from concessions is divided up in a 55-45 split between the team and Centerplate (the Giants PR office disputes this number, but it won’t divulge the actual split). So when a fan spends $17 for a hot dog and 16oz beer, Centerplate and its workers get $7.65 and the Giants get $9.35, all of it pure profit. And the Giants executives even set the concession prices, not Centerplate.

But the team says the plight of these workers isn’t its problem. “We continue to urge both parties to get back to the bargaining table and to have productive discussions so the matter can be resolved as quickly as possible. This dispute is between Centerplate and Local 2, not the Giants,” is the team’s public position on the issue.

The Giants communications office responded with this stance to every question the Guardian asked about the issues involved: What have you done to “urge” Centerplate to settle the contract? Couldn’t the Giants force a settlement if it really wanted to? Why haven’t concessions workers shared in the team’s success and rising revenues? How can you claim to support the community if you can’t even ensure the people who work in your stadium are paid minimum wage?

The Giants had nothing to say about a petition signed by 600 of the workers urging the team and Centerplate to agree to a deal, instituting a company-wide no-comment policy on the standoff with concession workers.

“It would be nice if they would come in and talk—not be a mediator, but to know what we’re asking for and say why they’re not providing it or why they feel they shouldn’t provide certain information,” Billie Feliciano, who has worked as a Giants cashier for more than 30 years, told us. “They could talk to the president of the union on that if they wanted to. You know, we’re not asking you to tell us how you spend your money. We just want to know how much control you have of this situation.”

Feliciano and her fellow workers just want the Giants to be team players.

 

 

WHO’S IN CONTROL?

Contrary to what the Giants may say, there is one pressing issue—job security for the workers—that is nearly impossible for the workers and Centerplate to resolve. Every worker interviewed for this story has explicitly said that job security is their most important goal.

Even Centerplate says only the Giants can offer job security to concession workers. If Centerplate goes out of business or loses its contract, the concession workers will likely lose their jobs, which is why they’re advocating for a succesorship clause that would guarantee their employment in that scenario.

When The Guardian inquired with the Giants office about the issue, its spokesperson once again responded, “This is an issue between the workers and Centerplate, not the Giants.”

But with the Giants controlling who runs its concession and how much they charge the fans, is Centerplate just an easy scapegoat for squeezing more profits from workers? Because on the subject of health benefits and wages, the two camps are separated by a wide chasm.

In order to qualify for healthcare, the workers need to work at least 10 games in a month (they’re eligible for health insurance only from June 1 through December 1) to have coverage a month later, which means that the health and well-being of the 750 workers hinges on Major League Baseball’s scheduler.

Workers almost got denied coverage for August because June only had nine games, but they ended up qualifying because they worked a private event at AT&T Park for the biotechnology firm Genentech.

Yet Centerplate wants to raise the number of qualifying games to 12, while Local 2 wants to keep it at 10 and grant healthcare coverage to workers who work every game in months with less than 10 games.

On wages, Centerplate has offered 25-cent increase in hourly pay, no retro raises for the years worked under the expired contract, and a $500 bonus. Though Local 2 has not put out an exact number on their wage demands, its spokesperson says Centerplate’s wage offers are beyond unacceptable; they’re insulting.

Centerplate’s main message in this quarrel is its insistence that the concessions workers are among the highest paid in the nation and that they accrue more benefits than most part-time workers. But the workers say that claim is misleading given the high cost of living in the Bay Area.

“If we were living in Dallas, Texas, I’d say yeah, we’re probably overpaid. But we’re not,” Anthony Wendelburger, who has been a cook for three years, told us.

The Bay Area is among the most expensive metropolitan areas in the nation. Last month, the business consultant Kiplinger published a list of the top 10 most expensive cities in the U.S. San Francisco was third behind Honolulu and New York, with nearby San Jose in fourth and Oakland eighth.

The average concessions worker makes around $11,000 in a year while some make upwards of $13,000 during the regular season. Based on differences in the cost of living, we calculate (using www.bankrate.com) that $11,000 translates to $7,760 if they served food and drinks for the Seattle Mariners, $7,880 for the Chicago Cubs or White Sox, and $6,530 for the Atlanta Braves.

 

 

THE OLD BALLGAME

At the Giants-Padres game on June 18, a Tuesday, several hundred protesters gathered at a rally to show support for the Giants concession workers. Most were affiliated with Local 2, but a few off-duty concession workers came to join the demonstration.

They implored the fans—most whom seemed to be just learning about the dispute—to abstain from purchasing any concession stand products. The rally started an hour before game time engulfed fans waiting in line with chants of “No justice, no garlic fries!” and “Ain’t no protest like an union protest because an union protest don’t stop!”

Inside the stadium, 44 protesters (all of whom had purchased tickets) staged a sit-in in front the garlic fries stand situated behind sections 122 and 123. Their numbers withered as the game progressed and by the fourth inning, the area in front of the stand was cleared and business resumed, with 10 protesters arrested for refusing to disperse.

That protest followed a more significant action on May 25, when all of the 750 workers staged an one day strike, authorized by a 500-16 vote by workers. For that game, Centerplate employed volunteer workers who only got paid in tips. Yes, the scabs got the tips that the regular workers are being denied.

Food and drink service during that game was significantly slower than normal, as even the Giants acknowledged. There were reports of fans standing up to 40 minutes in line for a beer, which is usually more than two innings, an amount of playing time that few true baseball fan would ever give up for a beer run.

Critics—including several passerby fans who were loudly expressing their disdain for the demonstrators at the Giants-Padres game—say the workers should be content with what they have, perhaps assuming the workers were getting more from that $10 beer than they really are.

When Pearlie Jones started working concessions at Giants games 22 years ago, hot dogs were $3. Today they sell for twice that amount at the stand that Jones now manages.

We met Jones at the Local 2 building in the Tenderloin. She lives in Daly City, survives on unemployment during the off-season, and has no other source for health insurance. With nervous laughter, Jones told us she “prays to God during [the off season] that I don’t get sick.”

Wendelburger, who has to commute almost two hours each way to the ball park, works as a bartender during the off-season, although he can only get three days a week. When asked about health insurance during the off-season, this husband and father of two says, “Unless I’m going to die, I’m not going to see a doctor.”

But Jones says that as important as improved wages and healthcare benefits are to her and other employees, they really fear losing their jobs: “Our job security is the main issue that we’re pushing for right now.”

One issue that seems telling of the way Centerplate and the Giants are treating concession workers is on the issue of tips. The workers are currently not allowed a tip jar or a tip line on credit card receipts, a standard feature of food service, particularly here in the Bay Area, where even butchers and bakers have tip jars.

Ramirez says she’s utterly baffled by Centerplate’s stubbornness on the issue. “A tip line is something that doesn’t cost management anything and requires a small change in the computer system and is something the customers are actually demanding. We have a great experience with our fans and customers and they want to share their gratitude and they can’t,” she told us.

Another seemingly minor yet deadlocked issue is the request for benches for in-seat food runners. These workers currently have nowhere to sit for breaks or in between food runs, yet Centerplate has refused to budge on that issue.

When asked about these minor demands, a Centerplate spokesperson said that they have not seen any list of demands from Local 2, a statement disputed by workers and Local 2.

Centerplate has cast workers as greedy, even filing a lawsuit against Local 2 claiming that the union and the workers are trying to exploit the Giants’ World Series championships, an action that the union and its workers heard about from reporters, adding to the aura of mistrust hanging over these negotiations.

 

 

LONG STANDOFF

Both sides have accused the other of not operating in good faith, something they both hope will change when negotiations resume on July 29.

Centerplate says it wants to give the workers a contract, but blames the deadlocked negotiations on Local 2 head Mike Casey, who also serves as the elected president of the San Francisco Labor Council.

“Unfortunately, Local 2 and its leader Mike Casey have not responded to our economic proposal. Our employees, and Local 2 members, remain without a contract, raise, bonus, and health security all because of Casey’s failures,” Centerplate spokesperson Gina Antonini told us.

But the concession workers seem to strongly support Casey, who was on vacation and unavailable for comment. “I have tremendous faith in our Local 2 union leadership. Mike Casey is brilliant,” Patricia Ramirez, a line cook of 14 years, told us. “I think Casey and [Local 2 organizer] Alphonso Pines are leading us in the right way and I think we’re going to win because of their guidance.”

Centerplate seemed unaware of Casey’s local reputation and community support. “The entire labor community is supporting Local 2 and our message is clear: If you have to go to the games, don’t buy the food” San Francisco Labor Council Executive Director Tim Paulson told us.

Local 2’s tough, deliberate, long-term strategy is one that has paid big dividends numerous times in its history, even if it has resulted in long standoffs with management, as was been the case with hotel workers in San Francisco.

“We have seen plenty of times that they have deadlocked for a period of time, they hold out, they tend to fight as long as it takes, and they tend to win” said Ken Jacobs, chair of the UC Berkeley Labor Center.

For their part, concession workers involved in the negotiations blame Centerplate lawyer and lead negotiator George Aude and his abrasive style for the impasse and the tense relations. Several workers we talked to cited Aude’s disrespectful demeanor, with one worker calling him a “giant hothead”.

In one of the negotiations, Aude made several irate comments, which Local 2 took as a threat. They say Aude demanded of the Local 2, “If you don’t stop all these actions you’ve been doing, we’ll offer you less money.”

We reached Aude to comment on the contract talks, he said simply “unsatisfied,” and when we asked for further details, Aude hung up and refused to answer our calls.

 

 

SUPPORTING THE TEAM

Mayor Ed Lee says he’s urging the two sides to settle the standoff and that he has offered to help, although he’s leaving it to the mediators involved. So for those keeping score, City Hall has offered help but the Giants organization has not.

Yet Lee’s half-hearted offer to help Giants workers belies his zealous efforts to promote the Giants and its brand. In February, Lee and the Giants launched a citywide anti-litter program called “The Giant Sweep,” named in honor of the Giants’ sweep of the Detroit Tigers in the 2012 World Series.

“Last year the Giants showed us that winning the World Series took a team effort that went far beyond individual heroics. It required the effort of every player, coach, manager, and support staff — not to mention the fans — to build a championship team. The same approach is needed to attack San Francisco’s litter problem. The Giant Sweep will help San Francisco remain a place where people want to live, work and visit,” the Mayor’s Office said in announcing the program.

Mayor Lee and Gavin Newsom awarded the Giants a “Key to the City” for their World Series wins. Pitcher Matt Cain was awarded a “Key” last year for his perfect game against the Houston Astros. Even disgraced slugger Barry Bonds was given a “Key” after passing Hank Aaron on the all time home run list in August 2007.

“You know, we usually give keys to individual dignitaries who have accomplished great things, whether it was the president of Ireland, or Tony Bennett, or even a Matt Cain on his wonderful perfect game in San Francisco,” Lee said during last year’s celebration. “We normally celebrate those individual accomplishments, but today, we’re gonna break with that tradition and present this key to the entire team and coaching staff, everybody involved in the Giants, the investors, their front office. Congratulations to a team that doesn’t know how to quit, never gives up, and defied the odds at every opportunity.”

Then the city spent nearly a reported quarter-million-dollars to throw its team a massive victory parade and San Franciscans went wild in celebrating the Giants, once again, as the concession workers waited to feel like part of the team.

Could Lee or other City Hall figures help solve the standoff? Other mayors have successfully intervened in situations like this before. In 2004, then-Mayor Newsom sided with the 4,300 picketing hotel workers after the hotels refused his request to end a lockout.

Less than a year before that, Newsom ran for mayor as a “business friendly centrist” who raised millions of dollars from the hotel industry and other downtown business interests. But when he saw that hotel management wasn’t being reasonable, he used the power of his office to help broker an agreement.

It would seem Lee could do the same thing if he wanted, particularly given that the Giants are currently asking the city for land and support to help grow its business.

STADIUM SPRAWL

The Giants organization is currently working on a $1.6 billion, 27-acre development project at Pier 48, located on the opposite side of Mission Creek from AT&T Park. The gargantuan project will include 1,000 housing units, 125,000 square feet of retail, 1.7 million square feet of office space, 2,690 garage parking spaces, and more than eight acres of public space. The project is on public land and will be subject to numerous approval processes, by both the city and the Port of San Francisco. Pier 48 and Seawall Lot 337 are some of the last valuable, easily developable sections of waterfront in San Francisco, so one might say the team is asking a lot from the community. And of course, Mayor Lee offered unqualified, enthusiastic support for the project, telling the Chronicle, “Among my highest priorities is to make sure our homegrown companies can stay, grow, and hire right here in San Francisco, driving job growth, improving our neighborhoods, and in this case our world-class waterfront.” But Lee, Centerplate, and the Giants seem to think that just creating jobs is enough, regardless of pay, benefits, and job security. “The success of a Major League Baseball club is measured by more than game-winning rallies and pennant drives. Beyond the box scores, a ballclub has a unique opportunity to create partnerships to improve the quality of life in its community,” the Giants proclaim on its community page. But for Giants workers, such sentiments have done little to improve their quality of life.

EDITORIAL There’s a troubling anti-democratic trend taking place in this country, one that’s been recently reflected everywhere from the US Supreme Court’s decision to strike down key provisions of the landmark Voting Rights Act to City College of San Francisco losing its accreditation and being placed under state control.

Maybe you’ve only been passively following the City College story, either because it doesn’t seem to directly affect you or simply because of mid-summer distractions, but here’s why you should care: power has been unilaterally stripped from the Board of Trustees, the people we elect to carry out our will, spend our money (including the parcel tax for CCSF that local voters overwhelmingly approved just last year), and strike the right balance between training students for jobs and universities and offering more community-based programming.

That can be a difficult balance to strike in San Francisco, with its multitude of interests and needs, and we can legitimately criticize how decisions are made or not made by this often dysfunctional board (as we’ve repeatedly done in these pages over the years). Democracy isn’t always the cleanest or most effective way to govern, but we as a country long ago decided that it’s an important experiment worth trying, and that it beats more autocratic alternatives.

But Mayor Ed Lee has been all too eager to give up on that experiment when it comes to City College, as he’s made clear in repeated public statements since the decision. Asked about the issue during the July 9 Board of Supervisors meeting, including the loss of local control over vital public assets and meeting halls, Lee once again praised the move “to save City College through a state intervention.”

Maybe that’s not a surprising position coming from a career bureaucrat who was appointed mayor with the support of powerful economic interests, but it should trouble those of us who haven’t yet given up on democracy, which is the stuff that happens between elections even more than casting ballots every couple years.

It’s about process and protests, coalitions and consensus-building, trial and error. As strange as it may seem to some, the Egyptian military’s recent removal of President Mohamed Morsi, whose unilateral dismantling of democratic mechanisms prompted widespread protests, was essentially a democratic act (albeit an imperfect choice between untenable options). That’s because that unilateral action was driven by popular will and accompanied by strong assurances to rapidly restore democratic institutions and leadership — something that has not yet happened in relation to City College.

Detroit has long been one of the most troubled big cities in the US, thanks to this country’s evaporating industrial sector and other factors. But when Michigan Gov. Rick Snyder implemented a state takeover of the city in March, fully half of the state’s African-American population was denied democratic representation. And since then, Snyder and other Republican leaders have magically found the funds that could and should have been offered in the first place to bail this city out. Instead, they’ve begun packaging up Detroit for the capitalist speculators.

If we aren’t vigilant, financially troubled California cities such as Vallejo and Stockton could be next on the urban auction block, and that list could grow from there given the ability of coordinated capitalists to withdraw investments and cripple any jurisdiction that opposes their interests (as writer Naomi Klein compellingly showed in her 2007 book The Shock Doctrine: The Rise of Disaster Capitalism).

Are we being a little alarmist about the state takeover of one, small democratic institution? Maybe, but there is good reason to draw bright, clear lines in defense of our experiment in democracy. The conservative-dominated US Supreme Court has already signaled its willingness to grease this slippery slope, led by Chief Justice John Roberts, who clearly is playing the long game and will likely be quarterbacking this effort for decades to come.

As the New York Times and other legal analysts noted after the court’s latest session ended, Roberts has been carefully laying the groundwork for an undermining of democracy, even when issuing rulings that ostensibly side with the liberals, as he did in helping strike down Prop. 8.

While we in San Francisco cheered the resulting legalization of same-sex marriage, what the ruling actually did was limit the power of the people to defend decisions made through the initiative process. And earlier that week, Roberts also wrote the ruling that the racial discrimination guarded against in the Voting Rights Act no longer existed, despite aggressive current efforts by Republicans to disenfranchise African American, Hispanic, and poor voters through disingenuous voter fraud laws, scrubbing voter rolls, and other mechanisms.

It was Thomas Jefferson, the greatest advocate for democracy among our founding fathers, who said, “The price of liberty is eternal vigilance.” In other words, we lose our liberty a chunk at a time if we don’t resist those who would trade democracy for efficiency (or in the parlance of Mayor Lee, “getting things done.”).

So the loss of local control over City College is something that should not stand, and we should all put be putting pressure on Lee and other locally elected representatives to demand a clear plan for when and how this important institution will be returned to local democratic control. If the Egyptian military can do it, clearly state education officials can as well.

Trayvon Martin: Can it happen here?

OPINION Like many others I have been captivated by the proceedings in the Trayvon Martin case. Personally, and as a member of the Board of Supervisors, it has inspired disappointment, outrage, frustration, and more questions about our criminal justice system than I have answers. But more than anything else this case prompts me to ask: Can this happen here?

However you feel about this particular case, we all like to think that in San Francisco we are more advanced than the rest of the country, and in most ways we are. From our Sanctuary City to our community policing strategies, we have always been conscious about race in our criminal justice system and City policies.

The neighborhoods I represent have 33 percent of the City’s African American population, more than any other area of our City, and we also have the highest concentration of young people, nearly 23 percent. More than half of the individuals who are incarcerated in San Francisco are African American and last year District 10 had the City’s highest number of youth on probation.

Regardless of their ethnicity, residents of areas that experience public safety challenges have a heightened sense of awareness or tension about what goes on in their neighborhoods. Unfortunately, sometimes seeing a young African American man is a trigger. It is a trigger to walk faster, be more alert, notify neighbors, or even call the police to report suspicious behavior.

This is the exact tension that a year ago led Mayor Lee to discuss implementing a version of New York City’s controversial Stop and Frisk Policy. Under this policy, each year police officers stop hundreds of law abiding citizens, the vast majority of which are African American, Latino, and young men on the suspicion that they may be engaging in illegal behavior. I was proud to join with many residents, faith leaders, and even our Police Chief in outlining more productive ways that we can interrupt violent behavior without instituting a policy based on racial profiling.

Thankfully, Stop and Frisk was never implemented in San Francisco, but the debate we had about it demonstrated that we still struggle with the role race plays in our criminal justice system and crime in our neighborhoods.

This verdict serves as a call to action for all of us that if we don’t want a similar tragedy to occur here, we must continue to do what San Francisco has always done best — lead the way. I will continue to push our City to have open dialogues about race in all of our public safety policies. I have spent the last year and will continue to do everything possible to strengthen our City’s regulations on gun control and work collaboratively with all of our communities to develop real solutions to violence that are rooted in protecting and supporting our neighborhoods instead of racial profiling.
