Activists rally for alleged victim of illegal foreclosure

A few dozen rallied in front of the building that houses a branch of PNC bank July 26, demanding that the bank not foreclose on Yin Wong, an elderly Bayview resident who says the bank is foreclosing on her illegally.

Wong says she never missed a mortgage payment on the home that she and her family have lived in since 2001. She was paying through electronic transfer, where payments were automatically transferred from her bank account monthly. She says that in October 2009, she discovered the bank had rejected her previous two payments. The next month, she received a foreclosure notice for non-payment. 

“I never said I cannot pay,” Wong says. She says after she was tracked for foreclosure, all efforts to pay were refused, even though she had the money.

“If it happened to another person, I wouldn’t believe it. But it happened to me,” Wong said, adding that “In other countries all over the world this wouldn’t happen…just America, of freedom and democracy.”

Protesters chanted in support of Wong and blocked the main entrance to 575 California, where PNC has offices. A security guard said the building hadn’t seen that kind of demonstration since it housed Chevron.

Activists compare Wong’s case to that of the Cruz family, who also had their electronic transfer payments to PNC rejected without explanation, resulting in being tracked for foreclosure and eviction from their Minnesota home. Their case galvanized national support and made headines when they travelled with supporters to PNC’s Pittsburgh headquarters last week.

Wong has received support from the Eviction Defense Collaborative (EDC), and two attorneys from the group were at the rally protesting on her behalf. One EDC lawyer, Deepa Varma, said that even with fairly obvious illegal foreclosures such as Wong’s, homeowners usually lose in the courts. The EDC would often warn clients that fighting against banks in these cases was a largely unwinnable uphill battle.

But she said the recent push to fight back against foreclosures, fueled largely by various Occupy efforts, has changed all that.  

“A year before Occupy, the position in our office was to say, you’ll just have to move,” said Varma. “It would have felt impossible”

But now, Varma said, “there’s more of us, and people have actually made it happen. The turning point for me was seeing Josephine get back in her house,” she said. Josephine Tolbert, 76, was locked out of her home was little warning last fall. After pressure from activists, including Occupy the Hood SF, Occupy San Francisco, and Alliance of Californians for Community Empowerment (ACCE), Tolbert has now received a loan modification and is back in her home.

“After that I was like, anything is possible so long as they realize we’re not going to keep quiet outside the courts,” Varma said.

Wong has been working with the EDC since she was served her first eviction notice three years ago. 

California is a non-judicial foreclosure state, meaning local governments automatically enforce foreclosures that lenders call for. Foreclosure cases are generally not reviewed unless a homeowner challenges a lender legally. Then, according to Varma, lenders need only prove that they filed appropriate eviction paperwork to prove their case—not that the foreclosure itself has legal merit.

Wong wanted to go to trial to prove her case, Varma said. “She said, I did everything right. I have nothing to hide.” But PNC wanted to settle the case through a series of motions of summary judgment. “They filed motion after motion,” recounts Varma, saying that courts almost always decide in favor of lenders in these types of motion. But Wong’s case was unusual– “we kept beating them.”

After three years, PNC finally beat Wong at a bench trial last month when a judge ruled against her. Their win was only based on being able to prove to the judge that they had record of the appropriate paperwork in Wong’s foreclosure preceedings, not that Wong had missed payments, meriting the foreclosure in the first place, according to EDC attorney Josh Schieber. 

Scheiber said that while he’s been working on Wong’s case, she has consistently tried to submit her payments and on the occasions offered to pay the whole mortgage. The bank doesn’t seem interested.

But Wong refuses to give up, and she hopes that the confrontation yesterday might have reopened those lines of communication.

Wong and an interpreter from Occupy Bernal waited in the building’s lobby about 45 minutes while supporters chanted “keep Yin in her home.” 

“They want to make me become homeless, but they still don’t want to talk to me,” Wong said as she waited, guessing “they’re scared because they know they did the wrong thing.”

PNC sent down a representative to meet with Wong who assured her that he would fax the documents that she had brought with her, evidence of the unlawful foreclosure, to corporate headquarters

Wong and her family are scheduled for eviction Wednesday.

“I hope they postpone it so we can keep talking,” Varma said.

UNAFF celebrates the power of films dealing with human rights, environmental themes, women’s issues, population, homelessness, racism, children, health, universal education, war and peace. In the past fifteen years, UNAFF has attracted a broad audience from the San Francisco Bay Area with regards to ethnicity—many finding the screenings to be a rare chance to see the state of human rights and culture in their own native countries. UNAFF promotes education, awareness and social change through images, dialogue and action.

Alex Tom and Shaw San Liu

Alex Tom and Shaw San Liu — the executive director and lead organizer for the Chinese Progressive Association, which celebrates its 40th anniversary on Aug. 4 — have laid the groundwork for a progressive resurgence in San Francisco by organizing Chinese immigrants and actively building close and mutually supportive relationships with working-class allies throughout the city.

The two have been involved in just about every recent effort to counter the pro-corporate neoliberalism that has come to dominate City Hall these days. They have seized space with Occupy San Francisco and they have supported labor unions and helped to create the Progressive Workers Alliance. They have fought foreclosures and pushed for affordable housing reforms, and they have protected vulnerable immigrant workers from wage theft by unscrupulous employers.

“Shaw San and Alex are incredibly talented organizers and movement builders who are managing to do the nearly impossible,” said N’Tanya Lee, who worked closely with the pair as the director of Coleman Advocates for Children and Youth. “They have built an authentic base of working-class Chinese immigrants who are interested in fighting for change in their community, and are creating a grassroots organization at the forefront of building multi-racial alliances to combat the divide-and-conquer strategies that are confronting us.”

Liu, who joined CPA six years ago, said she’s always inspired to see the old photographs on the walls of CPA’s office, and to read the history of CPA’s organizing and advocacy on behalf of working people. She said the organization has always understood the need to forge alliances with labor unions and other progressive interests.

“The organization itself has been, since its inception, playing a critical role in bridging the needs of Chinese interests with other communities,” Liu said. “I’ve always seen my role as bridge building.”

Today — with stagnant real wages, a deteriorating social safety net, and growing power by corporations that enjoy unprecedented political clout thanks to Citizens United and other court rulings — the need to organize people across cultural lines is more important than ever, even if that begins by addressing the individual needs of each community.

“Always at our core, it’s about empowering our folks to be able to voice their own struggles and visions,” Liu said.

Working to build that capacity within the Chinese immigrant community is hard and important work, Liu said, but it’s equally important to connect with the struggles of working class people from other communities, uniting to effectively counter the political dominance of employers and property owners.

Lui framed the struggle as: “How do we build unity and not have that be lip service?”

Tom and Liu have demonstrated that they know how to do just that, despite the diversity of sometimes-conflicting interests on the left and in a working class squeezed by recession and feelings of economic uncertainty.

“The issue that will unify people is good jobs that are accessible to everyone,” Liu said.

Yet she also said that working class organizing is needed to counter the simplistic “jobs” rhetoric coming from City Hall, which politicians are using to advocate for tax cuts to big corporations.

“More and more, it exposes itself as a total lie,” Liu said of the argument that the city should be facilitating private sector job creation with business tax cuts. “So much points to the fact that the US economic system doesn’t benefit everyone … When we talk about jobs, we talk about what kinds of jobs we want and for whom.”

Stardust and Ross Rhodes

Ross Rhodes and Stardust, like all of the people involved in Occupy Bernal, are neighbors. But until Stardust helped found the group — a local take on Occupy focused on stopping unjust foreclosures and evictions — they didn’t know each other.

Now they do, and if it wasn’t for Occupy Bernal, Rhodes is sure he would no longer have the house that his parents bought in 1964.

A former college football star, Rhodes injured his knees and back playing. He lives on disability payments, volunteering at the 100 Percent College Prep Club, and bringing home-cooked meals to seniors in his area. He also coached kids in the Junior 49ers program until it became too hard on his injuries.

Stardust, an ESL teacher and oboe player in the Bay Area Rainbow Symphony and the SF Lesbian/Gay Freedom Band, has been working for LGBT rights, women’s rights, and online civil rights for years. When Occupy took off, he gravitated toward the neighborhood fights against foreclosures.

Like people all over the US, Rhodes and his wife were fooled several years ago by a pick-a-payment loan plan. At the time, World Savings was peddling the deals through neighborhoods, promising potential borrowers that they could send their kids to college, buy a car, take vacations — and modify their loans after a year.

But when Rhodes started to apply for loan modifications, he was denied. He kept receiving letters asking for more information, often the same information he had already given — a common story that led to part of the Homeowners Bill of Rights that will guarantee a single point of contact from the bank. He was stumped when he was told he needed more income — the bank said it wouldn’t accept payments that were more than 30 percent of a borrower’s income, and Rhodes was getting a fixed disability check.

He found another income source as a homecare provider, but after all the time that the bank wouldn’t accept his payments, Rhodes was marked as someone who wasn’t making payments, and was tracked for foreclosure.

Meanwhile, Occupy Bernal was working on more than 100 similar cases in its neighborhood. The organizers hadn’t quite convinced Mayor Ed Lee to help at that point, but Rep. Pelosi’s staffers were on their side, getting banks to prioritize the cases of those working with Occupy Bernal. They worked with other community groups like Alliance of Californians for Community Empowerment (ACCE) to do physical occupations of homes. But for those who had received a notice of default and a notice of sale — two steps in the foreclosure process that precede the auction of a property — Stardust was there with another tactic.

He spearheaded Occupy the Auctions. He shows up at City Hall at 1:30 every day and tries to disrupt foreclosure auctions. He’s been there continuously since April 27, 2012, and has stopped dozens of home sales. When fighting the eviction of a neighbor, he is sometimes backed by more than 100 people. But many days it’s just Stardust.

Now, Rhodes is in a loan modification process. Rather than conflicting and confusing machine-generated paper work, he gets regular calls about the status of his modification from a point person in Wells Fargo’s executive complaint office. He testified in Sacramento in favor of the Homeowners Bill of Rights, which passed July 2. He’s also become an Occupy Bernal organizer on top of his other volunteer pursuits.

Stardust battles mega-banks and the city’s wealthiest in his work. But he says the biggest challenge is helping people to get over the shame they feel when they realize they are facing foreclosure. “It’s not their fault,” he says. “It’s the system.”

Friends of Ethics

In the summer of 2011, at the behest of the Ethics Commission, the Board of Supervisors put on the ballot a measure that would have loosened some of the rules for campaign consultant reporting, and would have allowed further changes in the city’s landmark ethics laws without a vote of the people. It had unanimous support on the board — and frankly, technical changes in campaign laws are not the kind of sexy stuff that gets the public angry.

But a small group, led in part by five former ethics commissioners, took on the task of defeating the measure. The activists also took on the challenge of defeating Prop. E, which would have allowed the supervisors to amend future measures passed by the voters.

Despite being outspent by tens of thousands of dollars, Friends of Ethics — a small grassroots operation — prevailed. Both measures were defeated (32 percent to 67 percent in the case of Prop. E, the worst loss of all the local measures on the ballot).

The group is great at forming coalitions: in the case of the No on E and F campaign, Friends of Ethics reached out to some 30 organizations that formally joined in opposing the measures after hearing presentations.

The members of FOE are a fractious group of organizers and shit-disturbers who don’t always get along or agree on other issues. But they’ve come together to do something nobody else does: make protecting and expanding political reform laws a front-line priority.

And the battle goes on. Not long after the November 2011 election, Supervisor Scott Wiener introduced legislation that would have led to less disclosure of political contributions before an election, and would have made it easier to conceal who was making contributions and paying for campaign mailers. The Wiener bill would weaken campaign contribution limit, giving the wealthiest donors greater power in elections.

When the amendments were heard at a well-attended Rules Committee in June (with plenty of public comment from Friends of Ethics), the supervisors sent the amendments back to the Ethics Commission to be rewritten.

The next step for the Friends of Ethics is to work with interested supervisors to push for changes to the city’s campaign laws that will actually benefit the public, such as increased transparency in election contributions and expanded campaign restrictions for those receiving contracts and other benefits from the city.

In an era defined by the US Supreme Court’s Citizens United case and a nationwide assault on fair elections, it’s critical work.

The Occupy movement

When Adbusters magazine called for people to show up on September 17, 2011, in New York City to protest the way Wall Street was holding the country hostage, no one could have predicted what would emerge.

It was the start of a movement, and San Francisco heeded the call. About 100 people gathered in the city’s Financial District. They started camping. And the effort exploded.

In the first few weeks, camps sprung up across the country. In Chicago and Los Angeles, in Bethel, Alaska and Tuscaloosa, Alabama, people were drawn together. But, unlike most protests, they stayed together. Night after night.

Along the way, a certain prevailing narrative from outside observers never quite got it right. First the camps were dismissed as nothing but bratty college students and hippies. Then they were called dirty and filled with homeless people. (Occupy challenged the whole idea of a monolithic homeless population. Once they had a home in the Occupy tent cities, homeless people were just — shocker — people.)

By December, when most of the campers had been kicked out, the narrative shifted. Occupy was resting, hibernating, many declared. Some snickered at the fair-weather activists who would only come out in the sunshine.

But in the Bay Area, at least, that hibernation story was simply false. On December 12, Occupy Oakland brought out thousands for its second port shutdown, in solidarity with port workers. On January 20, downtown banks were forced to close for the day and people in the streets celebrated Occupy San Francisco’s shutdown of the financial district. A week later, 400 were arrested when thousands tried to turn a vacant Oakland building into a community center. This was no hibernation.

Actions in some way inspired or fueled by Occupy have continued into the spring and summer. On March 1, Occupy, with a focus on student debt and accessible education, formed the 99 Mile March. Dozens marched from the Bay Area to Sacramento to join thousands of students and supporters in calling for an end to cuts to education; hundreds then occupied the Capitol building. On April 22, Occupy, with a focus on food justice, formed the Gill Tract Occupy the Farm action. Hundreds took a UC Berkeley-stewarded tract of land slated for a baseball diamond and a Whole Foods and planted it, turning it into a farm with rows of crops, a kids space, and a permaculture garden. On June 15, Occupy formed the Lakeview sit-in and Peoples School for Public Education, which taught day camp to children and refused to leave a beloved Oakland elementary school, one of five slated for closure.

Police eventually won the many-months battle with most Occupy groups in the Bay Area. The camps are mostly gone, though a tenacious group keeps its 24-hour protest in front of the Federal Reserve.

But because of Occupy — and its accompanying burst in resistance, creativity, and the belief that we really can, and must, come together to do something — dozens of Bay Area residents remain in homes that were facing foreclosure. Hundreds of people who felt forgotten and abandoned have found community. Thousands have been inspired to start their own projects and work with others.

When Adbusters called Occupy Wall Street to action, it was under the banner of “democracy not corporatocracy.” That ain’t an easy project. But it has already made the world a better and more hopeful place. 

Guardian Voices: A harsh city for queer youth

I moved to San Francisco at 19, having recently escaped small-town Texas because of ignorance and hatred associated with the fact that I am transsexual. I arrived on a Greyhound with a huge purse, a duffle bag, and big dreams for the queer wonderland.

Then life happened. Unable to find a job because I was too visibly trans, I ran out of money and ended up homeless.

Thousands of other young queers have runa way to San Francisco, but they still face daunting statistics once they arrive. Our city by the Bay has long been assumed a safe haven for the gays — however there’s more work to be done. It’s our responsibility, as San Franciscans and decent human beings, to ensure LGBTQ youth don’t face more violence and discrimination once they make it here.

LGBTQ youth face a disproportionate amount of obstacles to success, including bullying in school, family rejection, violence on the street, and job discrimination. After coming out of the closet, 26 percent of LGBTQ youth are kicked out of their homes by their parents. While LGBTQ youth account for only 5-10 percent of the population, we represent 40 percent of the homeless youth in San Francisco. The number of LGBTQ youth coming out and becoming homeless continues to increase, while funding for services to this very vulnerable population is cut back almost every budget season.

There are more than 94,000 LGB people living in San Francisco and approximately 6,000 LGBTQ youth, but there is still not a single queer homeless shelter. There are currently 36,000 vacant housing units in San Francisco, and only 6,000 homeless people; why can’t homeless people live there?

In recent years there have been a number of policy changes that have made life harder for the homeless. In 2010, proposition L, passed making it illegal to sit or lie on a sidewalk between 7am and 11pm. This law further demonizes homeless people who can be hit with $500 fines and even a month in jail for accessing public space.

In 2011, Scott Weiner, an out gay politician representing Harvey Milk’s former district, implemented a harsh new policy even further criminalizing homeless people in the Castro. This law makes sleeping, camping, cooking, creating a shelter, and using a four-wheel shopping cart all illegal at all times in Jane Warner and Harvey Milk plazas. The law goes further to ban the selling or bartering of merchandise without a permit.

In the 1970s, a similar sit-lie law in San Francisco was used to unjustly harass gay men. Harvey Milk crusaded against these laws until he was killed — and now the plaza named after him has the harshest sit-lie law in the city, and it’s driving LGBTQ youth out of the Castro.

“My queer friends are leaving the city because they feel run out of the Castro,” explains a homeless youth and active ally in the LGBTQ community. “We get harassed by cops at least three times a day, when we aren’t harming anyone at all. I was told by a police officer that me sitting on the benches in the Castro community was disrespectful of the hardworking people of the neighborhood. Then she told me to get a job.”

It’s our duty as citizens of a supposed sanctuary city to not turn a blind eye on the plight of homeless people, and especially not LGBTQ homeless youth. Let’s repeal sit-lie laws and stop cutting desperately needed funds for LGBTQ youth. Let’s create a shelter for LGBTQ people, and establish a permanent source of funds to make housing affordable for everyone. The solution to ending homelessness is not to increase criminalization and harassment; we need to expand our consciousness and compassion.

Free classes for all

Why should you need an expensive libereral arts education to ponder the question of realism, or pricey equipment to take a film making class? You don’t- the University of the Commons (UOTC) dove into its schedule of free, open to all classes a few weeks ago, and the effort is growing.

In a panel discussion at the summer session’s launch June 2, speakers placed the school in a radical context, mentioning other efforts such as D-Q University and Black Panther liberation schools like the Oakland Community School. 

The group’s mission statement says that the UOTC “aims to inspire participants to evolve more equitable and just societies and live more empowered and fulfilling lives.” The school isn’t accredited and students won’t get any formal acknowledgment of having taken classes there. 

It does, however, have some system-approved teachers. Dr. Barbara-Ann Lewis, who is teaching a class called Science Literacy to any and all who show up, is no newbie. She received her PhD in Soil Science from UC Berkeley in 1971, worked as a scientist at Argonne National Laboratory for seven years, and then taught environmental engineering at Northwestern for another 27. Since then she worked a stint as a violin-maker (“it’s good to have a trade,” she told me).

So what’s a pro like Lewis doing in a place like this? For her, its almost civic duty. “I want to teach the public,” she said. “The public votes, but has no idea about some of the real science behind the environmental issues.”

But in many of her university classes, “I had the standard students. They pay tuition, they come in, they don’t know too much about what’s going on in the world. They’ve lost their curiosity.”

She found students with that curiosity in her experience teaching with the Free University of San Francisco last year, Lewis says. “I had an 18-year-old and I had a 50-year-old in the class, lots of kinds of people, who all wanted to learn.”

Warren Lake of the San Francisco Free School, a similar effort that teaches free classes in the city, attended the launch in hopes of joining forces in some way with the UOTC. The Free School, Lake says, started with free yoga classes and has naturally offered movement, dance and other “right-brain pursuits,” compared to the UOTC’s heady academic offerings. Lake sees the Free School as “both a place to incubate teachers and for students to get together.” But when it comes to transferable skills and help along career paths, the picture is more complicated.

The Free School has been around for a few years now, and Lake says the accreditation issue is something he’s “thought about a lot.”

“There are different ways to show expertise,” said Lake. “Making a documentary or writing a book can often work as well as a college degree for showing you are interested of invested in something. There are different ways to market the experience.”

The University of the Commons is a great effort. But it brings up some questions. Who is it for? People who want an education but can’t afford one, now that the cost-free California community college system is a thing of the past? People who are already pretty well educated but always enjoy learning, not to mention generally fulfilling experiences? Students who want to supplement un-creative traditional schooling? People looking for friends and community who enjoy some learning on the side? Real change, liberation?

A Guardian article on a similar effort last year- the San Francisco Free University- pointed out that their effort was promising, admirable, and potentially very beneficial. It was also very white.

June 18, the pretty white- though, as members pointed out, also pretty female and queer- UOTC collective spent the majority of their meeting talking about “diversity and outreach.” They talked about teaching ethnic studies and women’s studies courses that are being cut out of public university curriculum. They talked about ideas for partnerships with organizations around the city that work with different groups, asking to see what kinds of free classes people there might want to participate in or teach. They talked about resources for classes in Mandarin and Spanish. They hope to plug in to existing efforts, and they hope to grow.

As of now, the classes range in the attendance. The students of Occupy U, a class discussing what worked and what didn’t in recent social justice efforts that focuses on Occupy, is about 11 mostly activist types, while From Mahler to the Music Video, a class tracing the history of music, has about 70 students that the instructor John Smalley says includes everyone from “professional musicians to homeless people.”

Next week will be the third week of classes, but you can still join in, although it might be a good idea to contact the instructor beforehand.

Chuckle connection: The Bay’s most diverse comedic line-up goes on tour

There’s no question that a childhood spent growing up Ethiopian in Haight-Ashbury made fertile ground in which to grow a stand-up career. That’s where Yanye Abeba is coming from. Abeba is performing in Kung Pao Kosher Comedy‘s second Color of Funny comedy tour on Thu/21 and Fri/22. Her schtick will be part of a unique line-up — and afterall, how many other people can pull on the interactions between their first generation African father and the homeless kids on Haight Street for their funny?

The divergent Color of Funny’s line-up can perhaps best be described as a comedic gumbo. Other performers include one of India’s few professional female stand-ups, venture capitalist turned storyteller Dhaya Lakshminarayanan. Joining her, award-winning broadcast journalist Maureen Langan (at the Thu/21 Berkeley show only) will bring tales of being the daughter of an Irish immigrant mother and garbage man father. Recent college graduate Nathan Habib (at the Fri/22 Santa Cruz) grew up in a Jewish-Israeli household with a Latvian mother and an Italian-raised dad. [Editor’s note: we interviewed Habib about pushy moms and Chinese restaurants back when he was a fresh-faced 21 years old.]

 

“There are so many points of view in this world,” Abeba says of this group of funny people in an interview with the Guardian. “Talking about our experiences in a comedic way gets people interested. They realize that even though their parents are from the ‘burbs and mine are from Africa, we have common experiences.”

Abeba’s acts recurrently discuss the clash between her Ethiopian and American backgrounds. “Ethiopian culture is so different from American culture and it makes for great comedy,” she says, adding that she is still shocked by how many people can’t find Ethiopia on a map but know the region was starving. “Inspired by Whoopie Goldberg,” Abeba employs comedy to combat cultural ignorance. Lately, she says her stand-up is focused increasingly on politics because she is concerned about this country. 

“I worry that people have become apathetic and aren’t really paying attention as their lives slip deeper into poverty,” says the comedian. 

So when the Occupy movement arrived in SF, Abeba was excited and began attending events. But she quickly became disenfranchised when she encountered people whose focus was on personal issues with parents and cops, not capitalism or the banking system. 

That disconnect became punchline fodder. “I just looked at it as another source for material,” she says. “Don’t get me wrong, I believe in the original message of the Occupy movement and I think that it is time things changed so that more people have opportunity. I think this country is for everyone, not just the Koch brothers.”

So she’s not diminished the Occupy ethos – but she is looping its reality in with her own activism of simply being a woman in stand-up. Because there are not many female comedians, and even less female comedians of color, Abeba has had to roll over several gender stereotypes. 

“I have a had a lot of men in this industry tell me that women have no place doing comedy, and that women aren’t funny,” she says. “They think all we do is talk about our periods and dating.”

She adds that if she had a nickel for every time she heard a man talk about anal sex and some hot chick, she would own a Range Rover. 

“Some of my favorite local comedians are different from the mold,” she says. “They are transgender, disabled, Indian, gay, and their point of view matters. As you get to know them through their comedy, you become more accepting of some one who is different because they touched you with their truth.”

At needle exchange sites around San Francisco, fliers are handed out to intravenous drug users warning them about a new and very potent form of heroin thought to be responsible for a dramatic increase in recent overdoses.

“Gunpowder heroin,” as it’s often called on the street, began infiltrating the city’s illegal drug market back around February, according to widespread reports from various needle exchange participants. Yet public officials appear to be in the dark about the epidemic, partly because budget cuts have created long backlogs for toxicology tests and partly due to indifference about the safety of drug users.

The reports were gathered by the Drug Overdose Prevention and Education Project from their network of needle exchange programs and analyzed by Project Manager Eliza Wheeler. She noticed the trend in April, and a flood of reports followed through May. It soon became clear that she was witnessing a potentially deadly spike in heroin-related overdoses.

“The whole city is reporting strong stuff,” Wheeler told us. “People are overdosing left and right.”

From January through May, 99 heroin-related overdoses were reported. The largest number of overdoses occurred in May with a staggering 40 reports. Wheeler says that an average month has 12 overdoses.

While those directly involved with San Francisco’s drug-using population seem to know all about the increase in overdoses, city and hospital officials seem to know nothing about it.

After checking with local police precincts in drug zones such as the Mission and Tenderloin, SFPD spokesman Sgt. Michael Andraychak told us officers haven’t come in contact with a strong batch of heroin and they are unfamiliar with the term “gunpowder heroin.”

According to Tenderloin Police Captain John Garrity, undercover and street officers only test controlled substances for positive or negative results. They do not test the drugs’ potency or chemical make-up. Garrity told us that the cops haven’t dealt much with opiate-related overdoses since the widespread availability of naxolone, an opiate overdose antidote commonly known by its brand name Narcan.

“We don’t see the overdoses anymore,” Garrity told us, “not for the last 20 years, not since Narcan came out.”

SF General, St. Mary’s, and St. Francis hospitals all say their emergency rooms haven’t seen an increase in heroin overdoses either and are also unfamiliar with the term “gunpowder heroin.”

It seems the city is content with letting nonprofit needle exchanges and programs like the DOPE Project deal with its opiate-using population. Although the DPH does fund and collaborate with many service providers, it rests the bulk of the responsibility on the drug users themselves.

While needle exchange programs combat blood borne diseases like hepatitis C and HIV, which can be contracted through sharing needles and other paraphernalia, DOPE attempts to educate users and prevent fatal opiate overdoses. The DOPE Project, funded through DPH, works with needle exchange programs to provide opiate users with a take home prescription of naloxone, which can be administered from a nasal spray or injected from a vial. At the exchange, if a returning drug user is re-supplying naxolone, he or she is asked “Did you lose it or use it?” If it was used, a report is made.

All the reports gathered by the DOPE Project are of overdose reversals, none of the reports are fatal, thanks to widespread availability of naxolone and the drug using population who use it. That doesn’t mean people haven’t died. In fact, a rash of fatal overdoses is rumored to have occurred. The suspected culprit: gunpowder heroin.

“There’s a new batch of heroin in town—people are dying,” says Johnny Lorenz, community activist and member of San Francisco Drug Users Union, a members-based organization advocating drug-friendly policies and giving a voice to drug users, who say they are often marginalized and seen as not caring about their community.

Lorenz, a former heroin addict, says a friend recently died from heroin-related causes. Whether it was gunpowder heroin that actually caused his death is unknown.

Wheeler and Lorenz say many people have died from the extra-strength heroin, yet no official records have turned up. The Medical Examiner’s Office hasn’t noticed an increase in heroin-related deaths, but Administrator Bill Ahern admits it was 90 days backlogged on toxicology reports.

The police and medical examiner’s lack of knowledge doesn’t surprise Mary Howe, executive director at Homeless Youth Alliance. She says heroin-related overdoses are indeed a real problem, and she personally knows heroin users who have recently died from overdose, but “unless you actually care about helping drug users you wouldn’t know.” And to receive a toxicology report from the medical examiner’s office takes a couple months, adds Howe.

Wheeler and others are currently waiting on toxicology reports to find out what exactly is in the heroin making it so strong. Without a toxicology report there is no way to be certain about the cause of death or the makeup of the drug.

According to SF Medical Examiner’s 2009-2010 annual report, nine out of the 141 people that died from narcotic analgesics related deaths were found with traces of heroin, down from previous years. However, finding out if heroin is the cause of death can be tricky. According to the report, the unique metabolite that identifies heroin, 6-monoacetamorphine, is very short lived and can metabolize in the body while the person is dying—leaving only traces of morphine or codeine.

Worse, a drug user buying heroin off the street will never know what exactly he or she is shooting.

“No one ever knows what’s in the heroin,” says Lorenz, adding that the label “gunpowder” has become a loose term for a stronger heroin. Lorenz, who spent the majority of his 20s doing heroin, remembers that gunpowder heroin at one time used to be a specific reference to a higher grade heroin from Columbia, off-white or grayish in color and crystal-like—resembling gunpowder.

Others say gunpowder heroin is black tar heroin mixed with fentanyl, a synthetic opiate that can be up to 100 times stronger than morphine. Some disagree entirely and say the overdoses aren’t specific to any one type of heroin.

“Whatever people are calling it—it is strong,” says Wheeler adding that people rarely overdose from of a bad batch of heroin; they overdose from a good, strong batch. “In a world where the drug supplies are unregulated, this is what happens.”

If it is black tar heroin mixed with fentanyl, that could explain why hospitals aren’t reporting an increase in overdoses, says Jan Gurely, doctor at a local homeless clinic. She suggests that the people aren’t making it to the ER’s—they are only making it to the morgues.

“‘Gunpowder is very dangerous,” says Dr. Gurely. “It takes a phenomenal amount of antidote vials to reverse the overdose.”

Naxolone unbinds every molecule of heroin from receptors in the brain, reversing an overdose. The problem with naxolone is when too much is administered the overdose victim goes into withdrawal and comes to sick and vomiting. With a normal heroin overdose only half a vial is needed, but multiple vials are needed when dealing with gunpowder, she adds.

“A person could die on you with a vial in your hand,” Dr. Gurely said. “Most people don’t walk around with six or seven vials of Narcan.”

Pauli Gray believes the type of heroin causing a rash of overdoses and deaths is indeed heroin mixed with fentanyl. However, he doesn’t think it is a pure form of the prescription narcotic, but a homebrewed batch. Gray works for the Syringe Access Services program at the San Francisco AIDS Foundation and also works directly with Eliza Wheeler and the DOPE Program.

“It’s called gunpowder and it’s all over the place,” Gray said, adding that heroin users are now actively seeking the extra-strength street drug. “When they hear dealers yelling ‘gunpowder’ they run and buy it,” he said. The street value has skyrocketed. Normally, a gram of heroin sells for $30, gunpowder is selling for $80 a bag, says Gray, and the bag can weigh as little as a quarter of a gram.

Gray says users have learned to shoot up very small amounts of the drug, although rumors of fatal overdoses are rampant. The other day he saw the drug for the first time. It smelled like vitamins and when cooked up it has small black flecks floating around, he says.

“People are selling it everywhere,” Gray said. “It’s really scary. We’re in overdrive.”

Noted queer writer and speaker Dan Savage sent a hopeful message to LGBT youth with his 2010 YouTube video, “It Gets Better.” But many queer youth in the Bay Area say they aren’t willing to wait.

“If my adult self could talk to my 14 year old self and tell him anything, I would tell him to really believe the lyrics from “Somewhere,” from West Side Story. There really is a place for us. There really is a place for you. And that one day you will have friends that love and support you, you will find love, you will find a community. And that life gets better,” Savage said.

Savage and his partner Terry Miller’s message went viral. It inspired hundreds of similar videos and eventually led to the creation of the It Gets Better Project, headquartered in Los Angeles. The videos were a response to a tragic cluster of suicides by children bullied for seeming gay, a trend that was only unusual in that the media picked up on it. And for many teens across the country, the “It Gets Better” videos provided crucial hope and support.

But last week, I was talking to Stephanie, Lolo, Ose, and Mia Tu Mutch, four Bay Area teens, about what its like to be a queer youth today. We were talking at the Lavender Youth Recreation and Information Center (LYRIC), a center for queer youth in the heart of the Castro.

When I asked about the “It Gets Better” videos, they all had the same reaction: “Ugh. I don’t like those videos. I don’t like those at all.”

“Those videos are depressing,” Lolo said.

“Yeah. ‘Just wait ’til you’re an adult?'” Stephanie asked.

“Just wait ’til you’re an adult, and your problems will go away,” Mia said, shaking her head.

“And it’s celebrities, too,” Ose noted. “‘I got thousands of dollars, and it gets better!'”

The four of them are facilitators at LYRIC, leading weekly community-building workshops that deal with issues queer kids face. Between 17 and 21 years old, these youth are not waiting for it to get better. They’re doing it for themselves.

 

LYRIC’S OUTREACH

LYRIC definitely promotes pride and empowerment. Founded in 1988, LYRIC organizers worked to secure funding for a physical space a few years later. Since then, this purple house on Collingwood has functioned as a crucial center for Bay Area queer youth. It offers counseling, food, clothing, community building workshops that kids teach, and a safe place to hang out.

But LYRIC, like many nonprofits, has felt the impact of the severe government cuts to health and human services. As a result, its budget has suffered steady declines from approximately $1.2 million in 2008 to $954,000 this, year primarily due to shrinking government funding.

But LYRIC refuses to give up offering paid internships, a rarity in the nonprofit world.

“The City has made it clear that they no longer intend to invest significant funding into subsidized employment model programs — they want to serve greater numbers of youth at a much lower unit cost — even if we all understand that some of the most marginalized youth will no longer be getting the intensive level of support they need to make it to a successful adulthood” LYRIC’s Executive Director Jodi Schwartz told me, explaining that the organization is now growing support by more grassroots funding networks.

“We used to hire 60-70 young people per year, now it’s more like 20,” Schwartz says.

The organization still serves about 400 young people per year.

“I would guess we have 6,000 queer youth living in the city,” Schwartz said. “So we’re not reaching everyone. Not to say that all those 6,000 queer youth need a LYRIC, but they need community. We all need community.”

Youth from across the country come to San Francisco seeking that community. Often they have escaped intolerant, abusive, or dangerous situations in their families or hometowns. But when they arrive in this storied city, these youth are often disappointed.

“I was that kid who left a small town in Texas and who got to San Francisco as fast as I could,” Mia told me. “And I was like, you know, I’ll figure it out, I’ll find a job, and I’ll do this and that. And it was really hard.”

” I think that the difference is that there are more LGBT specific languages and policies, and organizations that are affirming. All of that is the best in the US, probably,” Mia said. “And there are all these cultural groups and all of that. But queerphobia and transphobia exist here just like it exists everywhere else.”

“So my big thing is how we have all these systems in place that make us a little more queer friendly,” she said. “But how do we actually get the public to stop hating people, to stop doing hate crimes, to stop bullying?”

Ose, who now lives in the Bayview, grew up closer to the city. But coming from a religious family in Modesto, he says, “I had heard things about the Castro itself. I always thought the Castro was the devil…I was a church boy.”

He remembers fear that someone he knew would recognize him in the forbidden neighborhood, that “my mom would find out and be like, what are you doing in the Castro? So I was scared to death my parents would find out I was coming to the Castro.”

That was two years ago. Now, Ose works in the Castro, and he was dressed in cut-off shorts and a slicked back Mohawk, long painted nails clicking on the table. “I’m hella gayed out,” he happily reports.

When Mia made it to San Francisco, she initially settled into the Tenderloin, rather than the gentrifying Castro.

“As a trans person, a lot of trans history is in the Tenderloin and there’s a lot of trans women who live in the Tenderloin and who work in the Tenderloin,” she explained. “So I feel more at home there. Even though it isn’t technically the gay neighborhood, it’s always been the queer ghetto and that’s where the low income and queer people of color live a lot.”

The Tenderloin is also the site of many of the services that queer youth use. Mia made some of her first local connections at Trans: Thrive, a program of the Asian Pacific Islander Center. And many of the kids at LYRIC, as well as the city’s other queer teens, benefit from Larkin Street Youth Services.

The homeless shelter oversees the only beds reserved for queer youth in the city, all 22 of them, a number Schwartz believes in inadequate. A report from Larkin Street in 2010 found that 30 percent of the homeless youth they serve identify as LGBTQQ (lesbian, gay, bisexual, transgender, queer, or questioning).

LYRIC is part of the Community Partnership for LGBTQQ Youth and the Dimensions Clinic Collaborative, which includes service organizations like the queer-specific health clinic Dimensions, the nearby LGBT Center, the Bay Area Young Positives HIV health and support nonprofit, and the city’s Department of Public Health. But LYRIC is one of only a few organizations that focuses on fun, informative community-building workshops.

 

ACCEPTANCE NOW

Savage promised queer kids that, in the distant future, they would “have friends that love and support you, you will find love, you will find a community.” But LYRIC’s workshops, largely envisioned and run by the youth themselves, show kids that they don’t need to wait: they can create those supportive networks for themselves, in the here and now.

Another such community-building effort was on display at the LGBT Center on June 15: Youth Speaks’ queer poetry slam Queeriosity. The show, which was preceded by five weeks of free poetry workshops for and by queer youth, brought together young queer people from across the Bay Area, and one could feel the love and support in the air.

“Queeriosity is important because, in the poetry scene, we have so many people with so many different backgrounds,” Milani Pelley, one of the show’s hosts and a poet who works with youth in the workshops, told me. “A lot of times people who get identified in the LGBT category, they don’t have that space where they’re front and center and it’s a space for them. It’s very important that we celebrate everyone.”

Pelley, 24, has been working with Youth Speaks since she was 16. She said the message of the It Gets Better videos might be too simple.

“Thinking about being an adult versus a teenager, adults go through the same things,” she said. “The only difference is it’s not encouraged to speak out about it, you’re supposed to act like you have it together and it’s okay.”

Mia said youthful teasing and bullying are precursors to hate crimes: “Bullying and hate crimes are related because it’s all about people not accepting you, and then violently reacting to who are. So either throwing insults or beating you up.”

On April 29, Brandy Martell, an African American trans woman, was murdered in Oakland in a likely hate crime. CeCe McDonald’s recent case has also exhibited the dangers and injustice trans women of color face. The young Chicago woman defended herself against a bigoted attacker who she ended up killing, only to spend time in solitary confinement while awaiting trial, get convicted on manslaughter, and, last week, be placed in a men’s prison to serve her sentence.

I asked the four LYRIC teachers about the campaigns of national organizations like the Human Rights Committee — such as marriage equity or LGBT soldiers — and they all shook their heads.

“There’s a huge disconnect between the national platforms of the major gay organizations and the actual realities of queer youth,” Mia said. “Like they don’t even have queer youth in the majority of their meetings, but then they act like they’re the ones fighting for our rights, you know.”

For example, she said “marriage equality wouldn’t affect me at all. Yeah, it would be okay, it would be better if it was equal across the board. But when you have people dying because of hate crimes, and dying because of bullying, and dying because they don’t have a place to stay and they’re on the streets, it’s like, I just feel like those are a lot more pressing than getting a piece of paper from the government.”

 

SETTING THE AGENDA

Mia serves on the city’s Youth Commission, where she’s designing training programs for service providers to work with LGBT youth. Ose is working with Schwartz to create programming for LGBTQ youth who don’t want to take the common path of rejecting religion and spirituality as they come to terms with other parts of their identity.

“I go to church a lot,” Ose explained. “I grew up as a Christian. And I wanted to touch base on that because a lot of times, the youth that I come across, the majority of them are being silenced…I’m still going through some issues with my own church, especially with my pastor because just recently I’ve heard that he dislikes me over the fact of the way I dress, the way I act, my feminine gestures.”

Stephanie sighed and said, “I wish there were more LYRICS around the city. One in Bayview, one in every district. And Oakland too.”

“People who provide counseling, food, clothes, water if you need it,” Lola added. “A safe space to go to, a place where you can make friends, and make connections. There need to be more places like that specifically for queer youth.”

Even in San Francisco, harassment is a reality in youth programs and schools. In 2009, the SFUSD studied Youth Risk Behavior in San Francisco’s elementary through high school public schools, and found that more than 80 percent of students reported hearing anti-gay remarks at school, and more than 40 percent said they had never heard school staff stop others from making those remarks. The survey also found that students who identified as LGBT were significantly more likely than their peers to report skipping school out of concern for their safety.

Queer youth will never stop finding informal networks of support. But structured settings like LYRIC can be vital. At places like LYRIC, youth find the community, the love, and the friends that Savage promised would appear with time — before they turn 18.

“It’s easier to build relationships and to build community when its structured, when it has a little bit of structure like, hey, this is a queer specified setting, we’re going to talk to each other, we’re going to hang out, we’re gonna do this, and then you kind of build community off of that. And because it’s based on identity, you feel more comfortable to talk about that,” Mia explained. “You have to change your reality. And you have to be the one to change it for yourself. Because ain’t nobody gonna make it better for you.”

Bevan Dufty’s all wet and woofy

I’ve had issues with Bevan Dufty. Oh, lord, I’ve had issues. He so often voted the wrong way on the Board of Supervisors and was the only major candidate running for mayor who answered No to the affordable housing question at the Guardian mayoral forum.

But I have to say, he’s doing quite the creative job as the mayor’s homeless coordinator. I’ve always liked the idea of the “wet house” — a place where alcoholics can drink in safety. It’s basic harm reduction, something that sometimes conflicts with the prevailing wisdom on sobriety but will almost certainly save lives. He’s taking the right line on panhandling — the other day, he told me, he spoke in front of the Interfaith Council and complained about the notion of refusing to give money to panhandlers because they might use it for drugs and alcohol.

“Well,” he said, “there are people in this room who generate money for drugs and alcohol. What if that principle applied to your paycheck?”

(I always give money to panhandlers. I also spend part of my paycheck on Bud Light and bourbon. Deal with it.)

And now he’s got the puppy plan.

You can laugh at this all you want, and a lot of people will, but I think it’s a fabulous idea. It won’t solve homelessness, and I know that these little side trips can divert attention from the massive social problem that is housing costs and homelessness in this city, but still:

There are dogs that need to be adopted. There are lonely people who are in SROs who can adopt those dogs. It might keep some of them from panhandling. It will certainly make a number of canine and human creatures a lot more happy.

Remember PAWS? (One of my favorite groups.) These folks figured out in the worst days of the AIDS pandemic that having companion animals around made people’s lives better, and they worked to help people with AIDS keep their pets. Now they work with seniors and low-income people, providing support and services.

The dogs don’t care if their owners are living in an SRO; they’re happy to have a home. The people who might be isolated and stressed living alone and with very little money have a bit of light in their lives. Although a lot of SROs don’t take pets (and I get it — pit bulls on crack and fleas and shit), the Community Housing Partnership is working with Dufty on a pilot program, and if it works he cann push it further.

And that’s not the end. Under Sup. Scott Wiener’s recent legislation, dog walkers (thousand of ’em) are supposed to have some basic dog-training skills, and there aren’t that many places that offer those classes — but Dufty tells me he thinks maybe some low-income SRO residents can learn to teach dog training classes and make some money that way.

Again: Little stuff. I still want to tax the rich to provide housing as a human right for all. But things are not good on the streets of San Francisco, and every little bit helps.

 

 

Reduce, re-use, replace

Greg Gaar knows the names, characteristics, and birds and butterflies attracted by every plant in the native plant nursery that he tends. Last week, he proudly toured me through the garden, pointing out plants like Yarrow ("great for bees and butterflies") and the beautiful flowers of the Crimson Columbine, of which Gaar believes there are "only two others left in San Francisco."

Gaar has been working at 780 Frederick St., where he now tends the garden, for decades. His mother went to high school on the same block, the old site of Polytechnic High. Before Gaar became the gardener, he ran the recycling center that Haight Ashbury Neighborhood Council (HANC) operates next to the garden. Now, the pioneering green operation he helped build may shut down.

At the center, people can recycle their bottles, cans, paper products, and even used vegetable oil, and make some cash along the way. Those who use the center say it's a green and dignified way to make some money.

But residents in the surrounding area have complained for years that the center is loud and attracts homeless people. They also say that, due to their proximity to the recycling center, the chance that their trash will get rifled through at night is greater than in other parts of the city.

Citing these concerns, the center's landlord, the San Francisco Recreation and Parks Department (RPD), has spent the past few years trying to evict the HANC recycling center. The center got an eviction notice in December 2010. HANC's lawyer, Robert DeVries, successfully challenged the eviction. RPD sued for eviction again in June 2011, and that matter may finally come to a close June 6 when it will be heard by a three-judge panel in SF Superior Court.

DELIVERING THE GARDEN


RPD officials cite neighbor concerns, claims that the recycling center's services are outdated and obsolete, and the idea of planting a community garden in its place. In fact, the Planning Commission approved a community garden in the place of the recycling center last year.

Since then, HANC staff got to work building its own community garden. In just a year, they erected 50 beds from recycled wood, and according to Gaar, about 100 neighbors have plots that they currently tend.

As the recycling center's director, Ed Dunn, tells it, the infrastructure already in place at the recycling center made building the garden come naturally. HANC was able to fund it with income from the recycling operation, and plant it with seeds from the native plant nursery.

Dunn emphasizes that no city money was used to build the current community garden. The city had laid out a $250,000 budget for the garden after it was approved and designed in 2010.

A bundle of documents containing arguments against HANC, provided by RPD, includes details of the Golden Gate Park Master Plan, surveys indicating a great need for community gardens in San Francisco, and letters and statements from neighbors complaining about the recycling center.

A 2004 survey discussed in the documents found that community gardens are among the top "recreation facilities most important to respondent households." Community gardens came in fifth in importance, after walking and biking trails, pools, fitness facilities, and running and walking tracks. The documents include a detailed map of the "Golden Gate Park community garden preliminary plan," imagined at HANC's current site.

The map was drawn up in November 2010, the same month that a meeting of the Recreation and Parks Commission laid out the reasons that HANC had to go. Minutes from the meeting include the city's need for community gardens as well as some neighbors' disdain for the recycling center in that site. It argues that the needs of recyclers can be well met with other recycling centers in the city.

Seventeen other recycling centers operate in San Francisco. Most are located in neighborhoods on the city's edges, with a few in the Outer Sunset and Excelsior, although most are located in Bayview-Hunters Point.

But the commission doesn't seem concerned with potential nuisance to neighbors in directing more traffic to these other recycling centers, or with the difficulty poor recyclers have in getting out there. "The San Francisco Department of the Environment is confident that recyclers that use the facility will take their material to another existing site for proper handling," according to the meeting's minutes.

The commission is, however, concerned about a nuisance that the recycling center creates for Haight-Ashbury neighbors, according to the minutes. The notes cite "neighborhood noise, truck traffic, litter, and public safety concerns as negative impacts related to continuing operations at the site."

AGAINST THE POOR?


But is this really just another case of resentment against people who are poor and homeless?

HANC's Dunn argues that, in fact, much of the material that those who use the center bring in isn't taken from residential waste bins. Besides, it's not technically "HANC's CRV redemption program" that encourages recycling as a revenue source for the less fortunate. State law requires that consumers be able to redeem bottles and cans for cash.

The meeting minutes argue that the recycling center "enables illegal camping and illicit and unhealthy behavior in Golden Gate Parks' eastern end and in neighborhoods in close proximity to the site."

Supposed evidence for the position cites letters to the editor published in the San Francisco Chronicle, a frequent outlet for anger at the homeless. One concerned resident, Karen Growney, asserts that the center "provides no benefit to people living in Haight/Cole Valley."

HANC disputes this, saying that many neighbors use the center. They have beneficial relationships with many nearby businesses, including New Ganges restaurant just across the street. Its website, kezargardens.com, shows many smiling neighbors who use the center to recycle.

Notable among them is actor/activist Danny Glover, a Haight resident since 1957. In a video on the website, Glover — interviewed while in his car dropping off recycling at the center — says, "I would be dismayed and not happy if we close this wonderful recycling center down…It would be a tragedy, and a great loss to this city and this community."

In her letter, Growney also laments that her family "had to pay a considerable amount to build a wrought-iron, locked gate to keep people out of our trash." Another letter, written by neighborhood resident Curtis Lee, asks that the city "eliminate the Haight Ashbury Recycling Center," saying that, "It is a blight on the neighborhood and an attraction to rodents and homeless carts."

Of course, those carts come with people. HANC takes issue with the assertion that their services "enable" or "encourage" homelessness, as well as the assumption that the recycling center only serves the homeless.

Dunn says that many of the recycling center' clientele are elderly immigrants, often housed, who contribute to their family income with cash from recyclables. He also insists that "most of the people that use the recycling center don't camp in the park."

Homeless people certainly do use the center, but it's not clear whether its presence truly "enables illegal camping and illicit and unhealthy activity." Dunn finds it laughable to say that "the center creates homelessness." It's a lot of work to cart around recyclables all day, he says, and the dedicated recyclers are generally not the same people that ask tourists on Haight Street for spare change.

THE RECYCLERS


There is a great diversity in how homeless San Franciscans spend their days, and recycling is in many ways a specialized, committed way of life. In her 2010 ethnography of homeless San Franciscans, Hobos, Hustlers and Backsliders, Teresa Gowan focuses on the "recyclers," the segment of the homeless population who have made a habit of collecting bottles and cans as a way of getting by.

"The phenomenon that captured my interest was the steady stream of shopping carts loaded high with glass, cans, cardboard, and scrap metal rolling past my door," she wrote.

Some of her interview subjects show disdain for the recyclers, who work hard all day and don't get much cash out of it. Dealing drugs, stealing, or panhandling can be more lucrative and less backbreaking. One subject, a man named Del who, according to Gowan, mostly stayed in the Tenderloin, thought the "20, 25 bucks on a big load" that recyclers usually made was pathetic. "'And that's for heaving around a big old rattling buggy all day,' Del said pityingly. 'I can make 15 bucks inside'a two minutes.'"

But many of her interview subjects prefer to recycle anyway. Gowan describes another subject, Sam, as "a champion recycler, muscular and persistent, who often put in nine, ten hours on the trot." She quotes Sam saying, "Without this, I'd kill myself. Couple a days, I'd do myself in…. You get some guys, seems like they can deal with homelessness. I'm not one of them."

The book argues that "pro recyclers" included a "large core group who had created an intense web of meaning around their work as a kind of blue-collar trade."

PIONEERING HANC


Recycling for cash may not be a respected or taxed job "blue collar" job. But it's certainly green.

Since the center began operating in the 1970s, mainstream attitudes towards environmentalism and sustainability have shifted dramatically. The HANC recycling center was a product of the environmental movement, and helped usher in the widespread support for recycling.

Now, with curbside recycling fully functional in San Francisco, many call the recycling center's work obsolete. But HANC argues that the city needs all the help it can get if it is to reach its goal for zero waste in 2020. It also employs 10 people, and Dunn argues that it would be foolish of the city to eliminate those stable green jobs.

HANC has also helped move along the trend towards community gardens that RPD is now embracing so thoroughly that, ironically, it could lead to the recycling center's demise. HANC helped underwrite the Garden for the Environment project as well as the Victory Garden planted outside City Hall in 2008. Dunn says that the staff enjoyed the challenge of building the garden, and would be interested in helping the city by creating more gardens without city money.

Gaar says he's committed to continuing to work for a healthier planet, regardless of what happens to the center. He and the other HANC staff have come to see the eviction process as symbolic of a direction in which the city's heading, that also includes last year's Sit-Lie Ordinance: decisions designed to shuffle homeless people out of wealthy neighborhoods.
The arguments for the community garden, however, seem to indicate a strong desire for a greener city. It's not easy balancing environmental initiatives with NIMBY woes — especially when your backyard is Golden Gate Park.

Far from heaven

FILM Austrian writer-director Michael Glawogger’s narrative features include several comedies, which you wouldn’t necessarily guess from viewing his internationally better-known documentaries — in particular the “globalization trilogy” that began with 1998’s Megacities and continued with 2005’s Workingman’s Death. The first was a global survey of desperate lives on economic bottom-rung, from heroin-addicted NYC con artists to homeless Moscow beggars to sewer scavengers, slaughterhouse laborers, extensively pawed strippers, and so forth. The second was another look at modes of survival no one would choose, if they had a choice, from tapped-out Ukrainian coal mines to abandoned freight ships that Pakistanis risk their lives mining for scrap.

Constantly drawn to the ugly and wince-producing, these films nonetheless had a certain abstract grandeur wrought from cinematographer Wolfgang Thaler’s striking images and the director’s purist refrain from any external commentary. They were also criticized in some circles for questionably staged sequences, and for creating a sort of pornocopia of picturesque suffering halfway between Koyaanisqatsi (1982) and Mondo Cane (1962).

Now Glawogger and Thaler are back with their final panel in the series. The two-hour Whores’ Glory is itself a triptych, this time limiting itself to one profession — the world’s proverbial oldest — as it portrays life and business in three prostitution districts around the world. The services performed may (or may not) be the same, but the ways of conducting trade, and the attitudes toward it, are very different.

In Bangkok’s upscale enterprise “Fishtank,” the invariably young, slim women sit behind a glass partition to be checked out by customers until their number is called; the very non-PC comments uttered on either side go unheard on the other. Employees clock-punch in and out of work, have their own on site beauty parlor, and shrug “A job is a job.” Indeed, they seem more like unusually good-looking office temps than anything else, and are treated as such in an atmosphere of well-scrubbed corporate capitalism.

Faridpur, Bangladesh’s “City of Joy” area, by contrast, is a slum whose professional denizens are quarrelsome, foul-mouthed, high-drama, and often look well underage. Though primly clad by Western standards, they labor under a heavy societal mantle of shame — several we meet arrived here after being “driven out” of multiple prior locations. Others were sold by their impoverished families into one-year contractual obligations that one suspects will drag on much longer. “The crazy girl” is forever wailing, older women hector younger ones, a lot of raunchy talk is heard (“I tell them Allah didn’t create my mouth for that purpose” is the least of it), and johns flee the camera.

One exception is a junior barber who talks about coming here once or twice a day, and says that if prostitutes didn’t exist, horny men would assault “respectable women” on the streets. Therein lies the trouble, of course: the notion that sex (good sex at least) is never respectable, or that men can’t be expected to restrain themselves when faced with that massive cock-tease comprising 51 percent of humanity.

Finally, “La Zona” in Reynosa, Mexico is home to older, hardened, philosophical women as frank as their cheerfully horny customers. It’s a falling-down-drunk party scene in which one customer allows himself to be filmed in the act, while a retired sex worker describes a particular specialty she used to perform with an ice cube (“They bleat like goats”). The men curse and complement the women in the same breaths, Madonna-whore complex operating at maximum speed; one guy cruising around in a truck works himself into such a froth just discussing the local talent that you wonder if he’ll dirty-talk himself to climax. Yet there’s a forlorn quality to it all — even when a pro proclaims “I’m paid for it, I enjoy it. I’m paid to have fun,” the surroundings suggest she’s making the best of a deal that didn’t come with any better alternatives.

As usual Glawogger allows no overt commentary or judgment in another immaculately packaged object d’verite, this one sometimes a little too chicly scored to chill room tracks by CocoRosie, PJ Harvey, and such. More than its predecessors, though, Whores’ Glory could have used a little editorializing, or at least contextualizing. Is it even desirable to artfully yet passive observe this of all trades, so frequently rife with exploitation and complex moral issues? Raising myriad questions it’s too aesthetically clean to hazard addressing, the film becomes less an inquiry into than a scrapbook of prostitution ’round the world — a duty- (as well as STD-) free form of sex tourism for anthropologically inclined First Worlders. *

June 6 hearing may spell the end of HANC recycling center

It’s just a triangle of land on Frederick Street, right next to Kezar Stadium. But the Haight Ashbury Neighborhood Council (HANC) recycling center has been the subject of years of political battles- and depending on the results of a June 6 hearing, they may get shut down for good.

HANC got an eviction notice in December 2010. HANC’s lawyer, Robert DeVries, successfully challenged the eviction. The Recreation & Parks department sued for eviction again in in June 2011, and that matter may finally come to a close June 6. The Guardian is awaiting comment from Rec & Parks.

In December, the Planning Commission approved a plan to turn the site into a community garden. They meant a garden run by Rec & Parks, not HANC. But HANC got to work building one, and Executive Director Ed Dunn is proud to say that they did so “without a cent of taxpayer money.”

Dunn emphasizes that “over the course of the past year or so the operation has been completely transformed.” The new community garden has 50 beds, which resident gardener Greg Gaar says are divided into about 100 plots, are are planted with mostly native plants that are currently in full bloom.

“We could build one community garden like this per month at no cost to the city,” said Dunn, referencing a recent SPUR report that talked about the benefits and challenges of urban agriculture.

Said Dunn, “we can help fill in some of those challenges.”

The center has a history of working on the cutting edge of environmentally friendly trends. The site at 780 Frederick was established as a recycling center in 1974, a decade before San Francisco implemented curbside recycling. The curbside program became fully operational in the early ‘90s. But 18 recycling centers remain in the city- and state Bottle Bill laws require the existence of recycling centers in “convenience zones.” Dunn says the HANC recycling center fulfills the legal requirement to be nearby a recycling center for several supermarkets.

Now, many San Francisco residents rely on curbside recycling, rather than trucking their bottles, cans, and paper products to a recycling center. But a large population uses recycling centers- for excess amounts of recyclables that don’t fit in the bins, other material that doesn’t fit like large cardboard, or to generate income. Those who benefit from money traded for recyclables include housed people looking to supplement income, often immigrants and the elderly, and people living on the streets. But the center’s opponents have painted the population it serves as mostly or all homeless, and the city has argued for its eviction on the grounds that the recycling center attracts homeless people to the area.

“[Gavin Newsom] thought the eviction was one way they could ward off camping in Golden Gate Park,” said Dunn.

Some neighbors have raised concerns about the noisy garbage-picking in the nightime, and questioned the need for recycling centers with curbside in place. If the center is shut down, though, it won’t signal the end of recycling centers or those who benefit from them. It will likeley change where people go to cash in on recyclables; HANC’s recycling center is centrally located, while the majority of  San Francisco’s recycling centers are in neighborhoods on the city’s borders, including several in Bayview-Hunters Point.

Regardless of the centers effects on the community, HANC’s landlord, Rec & Parks, doesn’t legally need a reason to evict them- they just need to give notice. HANC has fought the eviction, but after almost two years of successful stalling, Rec & Parks may finally succeed.

SF needs healthy housing

My greatest frustration as a tenants’ rights and affordable-housing advocate in San Francisco is that, despite all the good efforts by a lot of good people, we never address the root cause of our housing crisis. We routinely enact laws and ballot initiatives, organize endless demonstrations and elect progressive politicians, but in the final analysis, these efforts are just a Band Aid on a bad system that leaves a lot of people without a roof over their heads.

A few years ago, Brian Basinger of the AIDS Housing Alliance and I pushed “no fast pass to eviction” legislation to stop the eviction of seniors and people with AIDS and other disabilities through the state Ellis Act.

Ellis allows a landlord to override just-cause eviction protections and evict all of the tenants in a building. It’s often used by speculators to flip properties — that is, buy them, evict the tenants, and create a tenancy-in-common (where there’s the same number of owners as there are apartments). The new owners apply for condo conversion so that, instead of sharing a percentage in the building, they actually own their own units.

No Fast Pass says that if someone uses Ellis to evict tenants, then the building can’t convert to condos for ten years. If any of those tenants are seniors or disabled, it can never be converted. The legislation helped. There was a drop in Ellis evictions. Unfortunately, landlords and speculators now employ intimidation, harassment and buy-outs to get rid of tenants, so that they don’t have to Ellis.

It’s time to get beyond Band-Aids. Housing should be a human right, guaranteed for all, as healthcare is in other nations.

When former Supervisor Tom Ammiano realized that 65,000 San Franciscans (15% of the population) were without health coverage, he (not former Mayor Gavin Newsom, who takes credit for it) introduced legislation to create what is now “Healthy San Francisco,” our city’s version of universal healthcare. It’s not perfect, but it tackles the problem the way it should be tackled: by making healthcare a human right and not a luxury.

The same needs to be done for housing.

As long as housing is a commodity, affordable only to those who have the dough, there will always be people left out in the cold — literally. Our city has more than 10,000 homeless people, not to mention scores of others living (through no choice of their own) in deplorable conditions. The city builds more market-rate housing than it needs, while units for those below 50 percent of the city’s median income fall far short of the demand.

A mandate to house everyone in the city has never been tried. I don’t have an exact plan, but a “Housing SF” (like Healthy SF) might be created by pooling together all of our housing resources and aggressively working to pull in more. If the proposed Housing Trust Fund happens, it should be initially used only for those who need it most — the homeless and the poor, remembering that shelters are not housing, even if they’re considered such under Care Not Cash.

Put a moratorium on market-rate housing. Turn all abandoned properties (both city and privately owned) into affordable units. Raise money by letting the big businesses (including the tech companies) cough up some dough. Use land trusts as much as possible to keep the new places affordable into perpetuity.

It’s time to dream big.

Sonic attack on the poor

It was 11pm on Thursday, May 3, and the ballet was just letting out. Affluently dressed dance enthusiasts streamed arm in arm down Grove street towards the Civic Center BART station chatting about the evening performance. That night’s show of Don Quixote at War Memorial and Performing Arts Center was likely excellent judging by the theatergoers’ exuberance.

As they passed by the Bill Graham Civic Auditorium, a half-dozen homeless people seated along the route begged the procession for change. Across the street and a block down Grove, a few homeless individuals had bedded down for the night in front of the Main Library.

It is these encounters, normal to urban life, that are at the center of a controversial strategy by Another Planet Entertainment, which leases the auditorium from the city, to drive the homeless away. They hope that by blasting a late night sampling of industrial noise through the venue’s sound system between the hours of 11pm and 7am, making sleep nearly impossible, that the homeless will be discouraged from congregating there.

A women selling the Street Sheet newspaper on the corner sums up the social tension that invoked the strategy. “They’re doing it to keep the homeless from sleeping there. All these people don’t want to see the homeless when they come through here,” she said, gesturing to the now thin stream from the ballet.

She had heard the noise over the past few nights and described it as deafening. “The first time I heard it I thought the building was under construction, then I thought a motorcycle gang was coming through. It is so bad it makes the windows of the building shake.”

Another Planet had no comment on the racket and would not say if the strategy would continue. But in an interview with the San Francisco Chronicle, company founder Gregg Perloff said the venue has had “an enormous amount of complaints” from their patrons about the homeless.

Late at night, police are powerless to respond to such complaints. The city’s carefully crafted sit-lie ordinance, which bars people from assuming either of those postures on city sidewalks during the day, is lifted between the hours of 11pm and 7am to satisfy constitutional concerns that have overturned similar ordinances in other cities.

“This it the first time I’ve heard of a strategy like this used against the homeless,” Bob Offer-Westort, civil rights organizer with the Coalition on Homelessness, said of the noise. “It is really problematic for a business to say that people on public property not breaking the law are a public nuance. It is a intrusion of a private company on public space.”

Standing in front of the building late on a foggy night, it’s easy to see why the homeless would gravitate to here. The building’s huge awning, covering much of the broad sidewalk, must be the easiest place to stay dry outdoors for many blocks. And since the demolition of the city’s old central bus terminal last year, it is perhaps the largest dry public space in the city’s core.

But is this sonic attack even legal? That’s a question that the Mayor’s Office and the San Francisco Police Department, neither of which answered our repeated inquiries, don’t seem to want to address.

San Francisco’s noise ordinance is a weighty document. Most cities suffice with a paragraph or two to regulate noise, while San Francisco’s ordinance runs nine pages. Noise, or rather the relative lack of it, seems of great importance to the city. There is even a city committee on noise.

The reason for the seriousness the city gives the issue of controlling excess noise is expressed in the very first paragraph of the noise ordinance: “Persistent exposure to elevated levels of community noise is responsible for public health problems including, but not limited to: compromised speech, persistent annoyance, sleep disturbance, physiological and psychological stress, heart disease, high blood pressure, colitis, ulcers, depression, and feelings of helplessness.”

Many of the cities homeless already suffer acutely from conditions on this list. Asked how an already vulnerable population could be affected by random industrial noise known to (and in this case intended to) cause agitation, Offer-Westort said, “It’s crazy to try to create these conditions, they are quite literally trying to create a civil disturbance, and not on their own property, but in a public space.”

With the adverse effects of noise pollution well-outlined, the ordinance goes on to state, “In order to protect public health, it is hereby declared to be the policy of San Francisco to prohibit unwanted, excessive, and avoidable noise.”

The ordinance pays particularly attention to licensed entertainment venues like the Bill Graham auditorium: “No noise or music associated with a licensed Place of Entertainment shall exceed the low frequency ambient noise level defined in Section 2901(f) by more than 8 dBC.”

As a matter of comparison the difference between a whisper and a quiet conversation is roughly an eight decibel increase, a relatively narrow margin. It seems reasonable that if you’re standing outside a venue, and the music coming from inside sounds louder than the person talking next to you, the city’s noise ordinance has been exceeded.

So motorcycles, saws, and other industrial sounds that were described at the auditorium late at night would range around 100 decibels without being amplified. Amplify it enough to shake the window in the building, one can assume it’s louder than a power tool, louder by far than the noise ordinance permits.

Everyone who has ever held a loud late night event in the city know the consequences of breaking the noise ordinance. A knock on the door by the SFPD that comes with a ticket and the end of your gathering. Do it again in a year and the fines doubles.

The strategy at the auditorium seems to be having some effect, but where the homeless will be shuffled off to is anybody’s guess. The reality of the homelessness crisis is there is no place for the homeless to simply move off too. With their numbers in the thousands, only bold political action on behalf of the city’s leadership can solve the problem.

“The root of the problem is that people can’t afford rent. Everyone who rents in San Francisco knows that it is way too expensive to live in this city,” says Offer-Westort. “We stopped creating public housing. Housing has become a commodity, an investment rather then a home, and that has driven up prices.”

Passing back through the area later at night, the building was quiet for the moment. A tow truck was loading a car out front with a beeping alarm, a motorcycle roars by, a boombox is playing across Civic Center Plaza, a man is yelling around the corner only to be drown out by a broken wheeled shopping cart clanking by. If this is the normal late night quiet of the streets, it’s a wonder the homeless get a moments sleep at all. But the building itself remains quiet right now.

A lone homeless man has bedded down in front but has not yet fallen asleep. Young and dreadlocked, he tells me that he has been in town only two days and is unaware of the controversial blasts of noise.

“God I hope they don’t do that,” he said from his sleeping bag. “It’s supposed to rain tonight. Why would they do that? As long as you are up before sunrise and move on, who are you bothering?”

And here in front of the auditorium in the middle of the night, with the concert patrons at home getting a comfortable night’s sleep, the question seemed valid. “It’s mean spirited. I think that we as society agree noise should be maintained at a reasonable level to not bother your neighbors,” said Offer-Westort. “The fact that their neighbors are homeless doesn’t mean they are not part of society.”

Sketching Sixth Street: In new show, Joel Phillips renders the unseen

“I’m really interested in the idea of anonymity within a dense urban environment and how the denser an urban population is, the easier it is to be overlooked,” Joel Phillips says over a glass of red wine on a far too windy night in the Mission. His show, “No Regrets in Life,” opens tonight at Satellite66 and will feature seven charcoal and graphite drawings of men and women he’s met on the corner of Sixth St. and Mission.
 
Phillips, a few months shy of 23, has spent significant chunks of time in Seattle, Santa Barbara, San Francisco, and New York. While he was living in New York, he started thinking more about the social dynamics of cities and how some people tend to get lost in the mix. “In New York no one really looks you in the eye, everyone brushes past you and moves past you,” Phillips says.

In an effort to counter this surplus of vacuous interactions, Phillips started asking one in every ten people he met on the streets of Manhattan if he could take their photo. “The response [was] overwhelmingly negative,” Phillips recalls. “Probably 85 percent of the people said ‘Fuck off, leave me alone, get out of my way, what the hell do you want my picture for?’”

But the ones who willingly posed in front of Phillips lens “were a very particular subset of the population — people who had time and were looking for interactions.” Phillips recalls conversing with Richard, a homeless man who became the subject of his first life size drawing, for three hours before taking his photo. “He had the most amazing story. He had been everything from a horserace photographer to a foot soldier in WWII in General Patton’s division.”

After graduating with an art degree from Westmont College, Phillips moved to San Francisco for a graphic design position; and for the city’s rich imagery and artistic potential. “Part of the reason I fell in love with San Francisco was its amazing diversity of people and how you can look at all these people on the street and really see stories, particularly in their eyes and the lines on their faces.”

Phillips fortuitously fell into an artist homeshare-studio space on the corner of Sixth and Mission — a massive building with high ceilings, large windows, and not much insulation. “I hadn’t really done my research on the corner,” Phillips says. “There’s a lot of homelessness and drug dealing, [and] I didn’t know until I moved there that it was one of the most crime-ridden corners in the city. But it’s a very communal corner in a strange way.”

Since moving to Sixth and Mission less than a year ago, Phillips has rapped with, photographed, and drawn a number of people on his corner.

Phillips says Spaceman OT, a man he approached and decided to draw, was “one of the most lively people I’ve ever met.” Spaceman “wears a life vest at all times in case of a flood, a bicycle helmet, and snowboard goggles. He bargained me into buying him lunch in exchange for a picture, so we hung out and he was just the most fun person — he was dancing around on the sidewalk, sweeping up things, he has these lightsaber battles with his broom — he pretends he’s Darth Vader.”

I’m really interested in “taking people we don’t know how to interact with on a day-to-day basis, particularly people who may be homeless, they might not be homeless, but don’t seem like they’re easy to approach, whether they’re talking to themselves or whether their coat has a hole in it, . . . out of that dark unlit area they’ve fallen into socially and bring[ing] them into a spotlight by obsessively rendering them.”

Phillips’ passion for people comes through within the span of a short (or in our case very long) conversation. “I’m not necessarily trying to make a statement about homelessness in general. I’m really just trying to take my own artistic process and apply it to these kind of people I find really interesting and amazing,” he says.

THEATER A couple of days after the opening of the Cutting Ball’s documentary play, Tenderloin, I spotted independent filmmaker Rob Nilsson crossing the street at Taylor and Eddy, less than a block from the theater. Drawn to the neighborhood and its residents for decades, Nilsson is one of the more prominent artists who have found inspiration, collaboration and a kind of authenticity in the Tenderloin, long among San Francisco’s poorest and liveliest districts.

Director-writer Annie Elias and her Tenderloin team continue this tradition, with a clear concern to do right by their subjects (among whom happens to be Nilsson himself, played by actor Tristan Cunningham). The action emerges from an opening tableau of street life, featuring the colorful sights and harrying sounds of a rowdy inner-city intersection (nicely augmented by sound designer Matt Stines). Upstage rises scenic designer Michael Locher’s ceiling-high mound of furniture and bric-a-brac, which is fronted by two rows of hanging photographs, loving portraits of local people and places whose panels double as projection screens establishing context for each of the scenes that follow.

The play presents a spectrum of Tenderloin denizens whose stories reflect the dire straits normally associated with this congested low-income slice of downtown, but also the sense of freedom and community some have found there. We hear from the desperate and lonely but even more often from people who have grown to prefer the Tenderloin to more stifling environs.

That positive note lands too forcefully at times, especially when it comes from relatively privileged members of the commuting class (the plugging of the neighborhood by some middle-class patrons at the Nite Cap bar, for instance, begins to sound a little like an ad from the visitors bureau), or professional advocates like Reverend Karen Oliveto (played by Leigh Shaw) at Glide Memorial Church.

By contrast, the play excels when the voices are both genuinely local and agenda-free, as is the case with the story by a man from Sixth Street who haplessly agrees to accept responsibility for a newborn baby from an acquaintance on her way to jail (a story as charming and resonant as a well-crafted short story, and beautifully recreated by actor Michael Kelly).

A set of discrete interviews naturally runs the risk of becoming an aimless narrative, especially without a single dramatic episode or storyline at the center (as is the case with the better-known works in the docudrama genre, such as Tectonic Theater’s The Laramie Project). Elias sets out to mitigate this problem in several ways, first of all by casting well — in terms of both the selection of interview subjects and the delicate portrayals marshaled by her exceptional ensemble of actor-documentarians (aided by additional writing from David Westley Skillman).

In addition to Michael Kelly’s standout performance throughout, Rebecca Frank does particularly subtle work with a number of memorable personalities, including Leroy B. Looper, the (recently deceased) owner of the Cadillac Hotel, who appears here with wife and longtime business partner Kathy (played gracefully by David Sinaiko). (Siobhan Doherty rounds out the production’s admirable ensemble.)

Elias also relies on dynamic staging, often setting a couple of interviews in alternating tension with one another, a technique that generally serves the production well — as in a sly point-counterpoint between former Tenderloin police captain Gary Jimenez (Kelly) and a homeless person (Cunningham) — even if some scenes prove unnecessarily busy.

But the narrative that emerges, which lays a heavy emphasis on “stripping back the layers” and revealing the truth of the much-maligned district, suffers from the accumulation of a familiar liberal slant toward tolerance and understanding. To the extent it undercuts outrage at a larger system of extreme and degrading inequality, such a slant obscures as much as it reveals. *

Who is the brick thrower?

The brick-throwing man whose projectiles hit two protesters at the Occupy San Francisco takeover of a Turk Street building on May Day has helped spark intense internal debates in the movement about the use of violence.

But nobody has heard the alleged hurler’s side of the story.

Jesse Nesbitt, 34, was arrested on the scene, and is accused of felony assault, assault on a police officer, and vandalism. I interviewed Nesbitt in San Francisco County Jail May 3. He spoke of his associations with drug addicts and revolutionaries; his previous stints in jails, prisons and psych wards; and his countless arrests on the streets of San Francisco for illegal lodging.

What emerged was a picture of a homeless Army veteran who suffers from untreated mental illness and substance-abuse issues — someone who found a degree of help and solace in the Occupy movement but has never fully escaped his problems. His story is, unfortunately, not unusual — there are many thousands of vets who the system has utterly failed.

Nesbitt told me he was diagnosed as schizophrenic at 16. “From bad things happening, my mental illness has snowballed since then,” he explained.

Nesbitt said he grew up in the projects outside Pittsburgh, Pennsylvania during the 1980s. “It wasn’t too nice,” he explained. When he was 18, he joined the Army.

“I wanted to join the military all my life. That’s what I wanted to do,” he said. The schizophrenia could have stopped him — but “I lied my way in.”

His tour in Korea was during peace time, but he says he still saw combat. “We were supposed to be at peace with North Korea, in a ceasefire. But whenever they got a chance, they shot at us. And whenever we got a chance, we shot at them.

“It hardened my heart. And it gave me a sense of duty to uphold our Constitution.”

Nesbitt returned from South Korea in 1996. Afterward, “I hitchhiked from coast to coast twice. I got married three times. I have a kid in Pennsylvania. I went to jail in Pennsylvania for — being young and stupid,” he said.

Later in the interview, he expanded on his prison time in Pennsylvania. “I did four years and eight months for aggravated assault, theft, and possession of an instrument of crime,” said Nesbitt. “I also did time in Georgia for assault. And I did time in Alameda County for vandalism and weapons.”

In fact, as he tells it, Nesbitt’s time in Berkeley was spent mainly in jail, before he got involved with Occupy Berkeley.

“I don’t know how much time I did in total in Alameda County. I’d be in jail two, three weeks, get out five, six days, then get arrested again. That was from last April to July,” he says.

On the days when he was free, “I was doing what I normally do,” said Nesbitt. “I’d squat somewhere. In the daytime I’d panhandle, go to the library. I was doing a lot of drinking. Then I started getting arrested a lot when I started doing meth.”

That was his life before joining Occupy. “A friend of mine who was shooting heroin at the time said, let’s go join the revolution. It will help clean you up. It helped pull me out of a drug addiction and keep me healthy,” said Nesbitt.

But that wasn’t the only reason he joined.

“I’ve always had revolutionary beliefs,” he says. He spoke of his friends in Pittsburgh. They wouldn’t let him go the G20 protests in 2009, fearing he would be incited to violence.

“I’ve been involved with anarchists for a long time. They pointed out documentaries I should watch, things I should read,” said Nesbitt.

But the example he gave me isn’t your classic Emma Goldman. Nesbitt remembered “The Esoteric Agenda” — a conspiracy-theory film that connects stories about corporate greed with apocalyptic prophecies.

“The education was getting me ready for something,” he said.

At Occupy Berkeley, even while Nesbitt recovered from his meth addiction, he continued to live in a cycle of violence.

“It was in Berkeley out at the Occupy camp. I got into a fight with somebody, I was in a black out. It took six cops to hogtie 135-pound me, so I was talking shit. While I was hogtied, they dropped me on my head. I went from talking shit to unconscious. I slept for the next two weeks,” Nesbitt told me.

His involvement with Occupy San Francisco increased after the Occupy Berkeley encampment was taken down.

Occupy San Francisco, however, didn’t quite progress the way he had hoped. “When they started raiding us in December, I was hoping the numbers would go up. Instead they dwindled,” said Nesbitt.

He was part of a small group of people continuing the “occupation” tactic outside the Federal Reserve Building at 101 Market St. Back in the fall, that sidewalk was a spot where dozens of people held protest signs and meetings all day and many slept throughout the night. After a series of police raids, and as most of those organizing with Occupy moved on to different tactics and projects, some decided to remain there.

Even when the Justin Herman Plaza camp was in full functional form, it was derided as “nothing but a homeless camp.” There were homeless people there, but many found food and other resources, as well as security from both police and other people they feared on the street, leading many to devote themselves to the goals of the protest movement.

The 101 Market camp that emerged in February was mostly a homeless camp — and, although the people there remained fiercely political in their convictions, they certainly didn’t enjoy the safety that the Justin Herman camp once provided.

Nesbitt was one of those people. “The SFPD not letting us sleep, telling us sitting on cardboard was lodging, sitting under a blanket to stay warm was lodging, you can only take so much of it,” he said. “They slammed my head against the back of a paddy wagon last time they arrested me for sitting underneath a blanket.”

His story is not unusual.

“Veterans continue to lead the nation in homelessness,” explained Colleen Corliss, spokesperson for the veterans-aid nonprofit Swords to Plowshares. “There are a lot of factors at play. Those who go to war have a higher instance of mental illness and substance abuse, which ultimately can lead to a vicious cycle of homelessness,” she said. “Even if you serve during peace time, you can still have really traumatic experiences.”

Nesbitt’s experience with the city’s mental health facilities wasn’t enough to break this cycle. “I did get 5150-ed,” he said, describing the term for involuntary psychiatric commitment. “I was in the hospital less than 24 hours, they kicked me out.”

Why? “I threatened to kill a doctor,” said Nesbitt.

Nesbitt’s 24-hour stay was in the overburdened, short-staffed psych ward at San Francisco General Hospital. When the psych wards began closing beds in 2007, it was comprised of four units, each with 30 beds; it is now down to one unit, according to Ed Kinchley, a social worker in the medical emergency department at General.

There’s also a floor in the behavioral health center for psychiatric patients with 59 beds, but “they told the staff last week that they’re planning to close 29 of those beds.”

“Since [the beds] are full almost every day, the bar or the standard for who stays there or who goes in-patient is a lot higher than it used to be,” said Kinchley.

Whatever the reason, Nesbitt was not getting treatment the day of the alleged brick-throwing — and he was having problems. “I was getting an episode the day before it all happened,” he said. “I was afraid to go by myself to sleep because I was hearing voices. Normally those voices tell me to hurt people. I try to keep around people I love and trust that wouldn’t let me do anything.”

Mixed with his schizophrenia is a brand of Constitutionalism that’s not common on the left.

“When you join the military or the police department, you take an oath swearing to defend the United States Constitution against all enemies foreign and domestic,” Nesbitt said. “Now they’re passing the NDAA, Patriot Act, and other bills I don’t know about. They’re intentionally taking away our constitutional rights. We’re supposed to defend those rights, not lie down and take it.

“I think Abraham Lincoln said, if the government betrays us, we’re supposed to take them out.” Nesbitt insists he’s “not a terrorist. No matter what they might say about me in the Chronicle or whatnot, I’m not a terrorist. What is he, then? “I’m a freedom fighter,” said Nesbitt. “I’m fighting for the freedom of everyone.”

Reflecting on violence at the SF Commune

Occupy San Francisco protesters entered Catholic Church-owned properties at 888 Turk last night. This is the same building that a similar group occupied April 1, in a peaceful action that lasted about 24 hours. 

The successful reentry was a testament to the spread of skills and cultures surrounding building takeovers by groups like Homes Not Jails. The resulting “rebirth of the SF Commune” was a mellow and pleasant event at first, as protesters on a march from the celebratory Peoples Street Festival joined in the commune. Some held back in the street while others entered the building in hopes of building a “community center”—most remained outside the building, enjoying a free meal cooked and served by some of the same Occupy SF kitchen volunteers that once fed hundreds of people daily at Justin Herman Plaza.


The building occupation was meant to affirm a strong belief in the rights of people to gather and organize, or at the very least have a warm place to sleep at night. It was also an assertion from Occupy: we’re still here, your warnings to property owners to board up their vacant buildings and the chain-link fence you put up in front of 888 Turk (which protesters casually removed upon arrival) won’t stop us.

“The Catholic church owns it. They’re supposed to be doing charity, but they’re leaving it vacant until they can get high rent out of it,” said Jazzie Collins that afternoon, an organizer with Senior Action Network who was there to support the May Day actions.

“There’s too many vacant buildings in this city, while people sleep on the streets.”

Collins spoke only for herself, but her take on the situation matched the sentiments of many who questioned the importance of property rights in the light of unused building and homelessness throughout the city. That’s the same reason that the SF Commune had sprung up in the same building, exactly one month earlier.

Police spokesperson Sergeant Michael Andraychak seemed to believe that this repeat occupation would turn out the same way. “We’re putting up some barricades attempting to restrict access to the building,” said Andraychak around 5pm. “We’re opening traffic back up.”

But not half an hour later, when the police put up the final barricades sealing off access to the building, the dozen or so people who got caught inside pushed back at the barricade. Police responded with intimidating and striking a few with batons. Then, a man appeared on the roof.

His face was covered in a black bandanna. He raised his arms, and in each hand, he held a brick. Onlookers began shouting, “don’t throw those!” He did though. He hit one man in the face, a fellow protester who, according to one source, has supported the Occupy SF effort since the camp.  

The mood of the crowd chilled. The brick-thrower held up more bricks, menacingly. 

Police closed the street off to traffic. Soon most protesters, supporters, and interested bystanders were on the other side of Gough or in the park, watching the events. A few spoke to and yelled at police lined up on the corners. Hundreds more police stood ground on Turk in front of the building. A few dozen remained inside, including one who had appeared on the roof, taken the bricks from the assailant, and tossed them off, out of reach.

Police arrested a suspect for the brick throwing as he exited the building out the back. Jesse Nesbitt, 34, is in custody in San Francisco County jail on $150,000 bail. According to sheriff’s department spokesperson Susan Fahey, he has been charged with three penal code violations: felony assault with force likely to cause great bodily injury (245a), assault on a peace officer with force likely to cause great bodily injury (245c), and felony vandalism of more than $400, 594b1.
 
A dozen or so remained in the building during the stand-off. Some poked their faces out an open window, hung down peace sign painted on a piece of cardboard, and talked into a megaphone. “We are not armed, we are completely peaceful,” one man assured. Meanwhile, police told press that they estimated 200 were inside and were “stockpiling pipes, bricks.”

The stand-off continued for a few hours until, at 7:30pm, police cleared out of the area. Most activists had left- thousands were massing in Oakland. But 40 or so people remained and re-entered the building. Many stayed until police came around 5am, arresting 26. Seven remain in custody, and all have been charged with trespassing. (Indicating that the weapon stockpiling concern turned out to be false. Which, as far as I could tell inside the building, it certainly was).

At that point, I entered the building as well to speak with those that remained. How did they feel about the violence? Did they think it was connected to the previous night’s events, when mysterious protesters destroyed numerous Valencia St businesses and cars in what some Occupy SF protesters suspect was an act of provocateurs?

For a response to come from Occupy SF, it must be consented on at a general assembly, a long process. So all the respondents represent only themselves- though most chose to remain anonymous. This structure can lead to a troubling lack of accountability: if something harmful happens at an action, who can be expected to explain it and help to prevent it in the future if everyone is responsible for only themselves? At the same time, each personal answer is less riddled in spin than a form answer would be, since people speak honestly, and for only themselves.

The Valencia St destruction “was enough that I didn’t come out and do anything today, whether it was Occupy or not,” one woman who had been “pretty involved in camp, back when it was at JHP” told me. “They were there to piggy back off an Occupy event, to use the organization of Occupy to organize themselves,”

The brick incident, however, did not caution her against showing up, as she did later that night. “Incidents like this happen often with mentally ill or violent people, but they get more publicity when they’re at an Occupy event.”

D, a longtime Occupy SF organizer, said wearily that “we were all surprised” at the incident.
“We weren’t expecting any bricks to be thrown,” he said, “and we didn’t want anyone to get hurt.”

But in terms of preventing similar actions in the future, D said, “We can only do so much. Everybody’s an autonomous individual and we can’t control what they do.”

“We can try to clean up everything that could be thrown, we did that last time. This time we focused more on stopping graffiti in the building. There wasn’t any.”

“That’s my friend. When I saw the brick flying at his face, I was hurt. Half our crew is in the hospital with him right now,” said another organizer. “But the real violence is the system putting people on the street, and the cops enforcing that. I’ve seen [Nesbitt] beat up by police.”

“What should we do, just turn our backs on people with mental illnesses?” another piped up.

“This whole occupy thing at this point is so spread out and separated,” said a self-described Occupy SF supporter. “There are parts that are revolutionary and parts that are more reform, and they’re trying to bridge that. I don’t know what it is at this point anymore. But I know I support a movement to articulate the rage at what’s happening in our country right now.”

What unfolds is a small, sweet and unexpected tale of connection and influence, amid today’s alienated dream-sucking American landscape — same as it ever was, if you ask Charles Bukowski or Henry Miller, both points of reference to Jasper and KJ, who borrow Bukowski’s poem The Aliens for one of their many band names. An appropriate name for the alienated, sure, but part of the charm of these characters is just how easy they are to recognize, or how much we can recognize ourselves in them. Delusions of grandeur reside in every coffee house across this wistful, restless land. It’s not just Jasper and KJ who may be going nowhere. A final gesture to the young and awkward but clearly capable Evan suggests, a little ambiguously to be sure, that there’s promise out there yet for some. But more than that: the transaction makes clear by then that there are no fuck-ups, really; not among people with generous and open hearts — never mind how fucked up the country at large. (Avila)

Cheap thrills don’t come much cheaper or more thrilling than at a Thrillpeddlers musical extravaganza, and their newly remounted run of Hot Greeks affords all the glitter-dusted eye-candy and labyrinthian plot points we’ve come to expect from their gleefully exhibitionist ranks. Structured as loosely as possible on Aristophanes’ Lysistrata, Greeks appropriately enough follows the trials and tribulations of a college sorority tired of “losing” their boyfriends to the big football match every year (Athens U vs. Sparta Tech). Pledging to withhold sex from the men unless they call off the game results in frustration for all, only partially alleviated by the discovery that sexual needs can be satisfied by “playing the other team,” as it were. But like other Cockettes’ revivals presented by the Thrillpeddlers, the momentum of the show is carried forward not by the rather thinly-sketched narrative, but by the group song-and-dance numbers, extravagant costuming (and lack thereof), ribald wordplay, and overt gender-fuckery. In addition to many TP regulars, including a hot trio of Greek columns topped with “capital” headdresses who serve as the obligatory chorus (Steven Satyricon, Ste Fishell, Bobby Singer), exciting new additions to the Hypnodrome stage include a bewigged Rik Lopes as stalwart sister Lysistrata, angelically-voiced Maggie Tenenbaum as the not-so-angelic Sodoma, and multi-faceted cabaret talent Tom Orr as heartthrob hunk Pendulum Pulaski. It’s All the Rage Studio Theater, Marsh San Francisco, 1062 Valencia, SF; (415) 282-3055, www.themarsh.org. $15-50. Thu, 8pm; Sat, 8:30pm, Sun, 7pm. Extended through May 27. Longtime comedian and radio host Marilyn Pittman’s solo play wrestles with the legacy of her parents’ violent deaths in a 1997 murder-suicide initiated by her father. It’s disturbing material that Pittman, a stout middle-aged woman with a gregarious and bounding personality, approaches indirectly via a good deal of humor — including recounting the first time she did her growing-up-lesbian bit before her mother in a DC comedy club. But the pain and confusion trailing her for 13 years is never far behind, whether in accounts of her own battle with anger (and the broken relationships it has left in its wake) or in ominous memories of her too complacent mother or her charming but domineering father, whose controlling behavior extended to casually announcing murderous dreams while policing the boundaries of his marriage against family interference. A fine mimic, Pittman deploys a Southern lilt in playing each parent, on a stage decorated with a hint of their Southwestern furnishings and a framed set of parental photographs. In not exactly knowing where to lay blame for, or find meaning in, such a horrifying act, the play itself mimics in subtler form the emotional tumult left behind. There’s a too brief but eerie scene in which her veteran father makes reference to a murder among fellow soldiers en route to war, but while PTSD is mentioned (including as an unwanted patrimony), the 60-minute narrative crafted by Pittman and director David Ford wisely eschews any pat explanation. If transitions are occasionally awkward and the pace a bit loose, the play leaves one with an uncomfortable sense of the darker aspects of love, mingled with vague concentric histories of trauma and dislocation in a weird, sad tale of destruction and staying power. Brian Copeland (comedian, TV and radio personality, and creator-performer of the long-running solo play Not a Genuine Black Man) returns to the Marsh with a new solo, this one based on more recent and messier events in Copeland’s life. The play concerns an episode of severe depression in which he considered suicide, going so far as to purchase a handgun — the title coming from the legally mandatory 10-day period between purchasing and picking up the weapon, which leaves time for reflections and circumstances that ultimately prevent Copeland from pulling the trigger. A grim subject, but Copeland (with co-developer and director David Ford) ensures there’s plenty of humor as well as frank sentiment along the way. The actor peoples the opening scene in the gun store with a comically if somewhat stereotypically rugged representative of the Second Amendment, for instance, as well as an equally familiar “doood” dude at the service counter. Afterward, we follow Copeland, a just barely coping dad, home to the house recently abandoned by his wife, and through the ordinary routines that become unbearable to the clinically depressed. Copeland also recreates interviews he’s made with other survivors of suicidal depression. Telling someone about such things is vital to preventing their worst outcomes, says Copeland, and telling his own story is meant to encourage others. It’s a worthy aim but only a fitfully engaging piece, since as drama it remains thin, standing at perhaps too respectful a distance from the convoluted torment and alienation at its center. (Avila)

*The Kipling Hotel: True Misadventures of the Electric Pink ’80s New venue: Marsh Berkeley, 2120 Allston, Berk; (415) 282-3055, www.themarsh.org. $20-50. Sat/5, 8:30pm; Sun/6, 7pm. This new autobiographical solo show by Don Reed, writer-performer of the fine and long-running East 14th, is another slice of the artist’s journey from 1970s Oakland ghetto to comedy-circuit respectability — here via a partial debate-scholarship to UCLA. The titular Los Angeles residency hotel was where Reed lived and worked for a time in the 1980s while attending university. It’s also a rich mine of memory and material for this physically protean and charismatic comic actor, who sails through two acts of often hilarious, sometimes touching vignettes loosely structured around his time on the hotel’s young wait staff, which catered to the needs of elderly patrons who might need conversation as much as breakfast. On opening night, the episodic narrative seemed to pass through several endings before settling on one whose tidy moral was delivered with too heavy a hand, but if the piece runs a little long, it’s only the last 20 minutes that noticeably meanders. And even with some awkward bumps along the way, it’s never a dull thing watching Reed work. (Avila)

Marga Gomez is back at the Marsh, a couple of too-brief decades after inaugurating the theater’s new stage with her first solo show — an apt setting, in other words, for the writer-performer’s latest monologue, a reflection on the inevitable process of aging for a Latina lesbian comedian and artist who still hangs at Starbucks and can’t be trusted with the details of her own Wikipedia entry. If the thought of someone as perennially irreverent, insouciant, and appealingly immature as Gomez makes you depressed, the show is, strangely enough, the best antidote. Mark Rothko (David Chandler) isn’t the only one painting with a broad brush in this labored and ultimately superficial two-hander by John Logan, enjoying a competent but underwhelming production by outgoing Berkeley Rep associate artistic director Les Waters. Set inside the late-1950s New York studio of the legendary abstract expressionist at the height of his fame, the play introduces a blunt and brash young painter named Ken (John Brummer) as Rothko’s new hired hand, less a character than a crude dramatic device, there first as a sounding board for the pompous philosophizing that apparently comprises a good chunk of the artist’s process and finally as a kind of mirror held up to the old iconoclast in challenging proximity to a new generation that must ultimately transcend Rothko’s canvases in turn. The dialogue holds up signs announcing intellectual and aesthetic depths but these remain surface effects, reflecting only platitudes, while the posturing tends to reduce Rothko to caricature. Much of the self-consciously reluctant filial interaction here smacks of biographical sound bites or heavy-handed underscoring of theme, and tends toward the outright hokey when touching on the credulity-bending subject of Ken’s murdered parents — with the attendant shades this adds to Rothko’s and the play’s chosen color palette. Lively crowd takes over Financial District

About 1,000 people gathered in the Financial District for a May Day convergence, blocking traffic at the intersection of Market and Montgomery and painting a huge yellow sun on the street with the caption “Rise up 99% Levántese!”

The lively crowd listened to music and speeches and participated in street theater.

Police were on hand in a line in front(415) 517-5910 of the Wells Fargo bank but as of the time of this post, there were no arrests.

In sharp contrast to the violence in the Mission, the actions have been peaceful.

The first march left 24th and Mission at around 10:15. Focused on immigrant rights — long a central tenet of May Day in the US — the event was planned by a large coalition including Mujeres Unides de Activas, HAVOC, SF Pride at Work, Young Workers United, and others.

The upbeat crowd of several hundred made its way to 16th and Mission, where police stood by as protesters took over the intersection for street theater.
A giant puppet representing the Earth held center stage. One player represented a banker; another tried to buy a house, but wound up homeless. When the victim of financial-sector greed sat down on the street, a “police officer” arrived to make a sit-lie arrest.

Tiffany Altamirano, with Young Workers United, told us, “My husband is undocumented. People are here whose brothers sisters and parents have been deported.”

The crowd took the intersection for about 40 minutes.

By mid-day the action had moved downtown, to the Westfield Mall, where a banner was dropped inside and pickets stood outside, showing solidarity with the SEIU Local 87 janitors who are in a dispute with building management.

Soon nearly 1000 converged on Market and Montgomery. Activists with The International Forum on Globalization giving away hundreds of books and pamphlets with critiques on global capitalism. A massive cutout of Goldman Sachs CEO Lloyd Blankfein stood in the middle of Montgomery, looking evil, with a message decrying corporate power.

Almost two dozen SFPD cops stood guard, with six police vans waiting nearby to haul away protesters. But the authorities seemed to be just letting the party happen with no orders to disperse.
