Why rent control works

I shouldn’t even bother to talk about this, because all it will do is stir up the trolls, but I’m getting sick of all the talk about rent control being a source of San Francisco’s housing problem. The latest is an editorial in the Business Times, which I buy to read J.K. Dineen’s stories about commercial real-estate, among other things. I should treat it like the Wall Street Journal; nobody takes the Journal’s editorial page seriously.

But the BT is just putting in print the argument that I’m hearing from the neo-libertarians who seem to be more and more populous in this town. And it goes like this:

Rent control distorts the market, which should be controlled by supply and demand. When you have rent control, evil tenants can stay in one place a really long time, thus “reducing urban vitality by discouraging mobility.” They can save their money for something other than rent. And it’s deeply unfair to landlords, because, as the BT notes:

By artificially limiting the return a building’s owner can generate on his investment, it discourages him from spending to maintain or upgrade the city’s housing stock. Rent increases are ordained not by supply and demand but by the city’s rent board. Legally, controlled rents can only go up each year by a fraction of the inflation rate. The ability to recoup costs of improvement or maintenance are also tightly curtailed. Costs are subject to no such limitations, so generally as a rent-controlled landlord, the longer you do it, the further behind you get.

Actually, rents go up by the percentage of the inflation rate that’s due to housing. The ability to recoup maintenance costs are not “tightly curtailed.” But more important, this notion that landlords “get further behind” because they can’t raise the rent assumes that most landlords — and their bankers — are idiots.

When you buy a piece of rental property, you typically have to prove to the bank that the rental income from the place is adequate to cover the mortgage, the taxes, the insurance, and upkeep, the same way a person buying a home has to prove that he or she has adequate income to pay the costs. When banks make loans the borrowers can’t repay, you get the mortgage crisis we’ve seen — but most of those units were single-family homes.

If I buy a rental property, the rent that’s coming in TODAY is matched with the price I’m paying TODAY. If the rents are too low to cover the cost, I have no business buying the place. And the bank has no business loaning me the money.

In San Francisco, unless you’re a complete moron, you buy rental property knowing, as the banker does, exactly what the current tenants are paying, and understanding, as the banker does, that the law won’t let me raise those rents by more than a modest amount each year. You’re making a profit at those rent levels; if not, you shouldn’t buy the place.

Now: Under Prop. 13, your property taxes can’t go up by much more than the rent goes up each year. And if you aren’t a speculative gambler (if you are, you have no rights anyway), you almost certainly have a fixed-rate mortgage. So your biggest “costs” are just as constrained as the rents you get. Meanwhile, your property continues to appreciate in value as the tenants pay your mortgage and taxes.

I know a lot of landlords in San Francisco, and the honest ones all say that owning rental property is a great deal — for the owner. There are probably some poor landlords who either (a) made bad business decisions or (b) were subject to some awful disaster and now find themselves unable to make ends meet. But they are not common.

Here’s the bottom line: Rent control prevents landlords from making speculative profits when the housing market booms. It also allows non-wealthy people to live here, for long periods of time, and become part of the San Francisco community. Housing stability INCREASES “urban vitality.” That’s the point.

Real, effective rent control would include limits on rent increases when a property becomes vacant. Berkeley had that in the 1980s. It didn’t cause urban blight or landlords abandoning buildings; instead, it helped create the Gourmet Ghetto and a thriving local business scene because tenants had more money to spend. It was a great success, until the state outlawed it.

Oh, and don’t tell me it discourages new construction: All new construction, since 1979, is exempt from rent control in San Francisco.

Rent control is, I will admit, bad for people who see housing as a speculative commodity, to be traded with little regard for its function as a basic human right. But I see housing more as a regulated utility — private owners have the right to a regular, acceptable return on investment, but not to excessive profits. Tenants have the right to live in the same place their entire lives, as long as they pay the (stable) rent and don’t become a nuisance.

These are good things for a city. The only problem with San Francisco rent control is that it isn’t strong enough.

Attack me, trolls. Or better, make a civil counter-argument that doesn’t start with “The problem with Tim is ….” Cuz we all know about my problems.

 

 

Those overpaid, underworked public employees

Before you start griping about ovepaid Muni drivers and public employee unions, you might want to take a look at this neat-o map that shows who the highest-paid public employees are in every one of the 50 states. Hint: It’s not a bus driver. Or even a cop or firefighter:

You may have heard that the highest-paid employee in each state is usually the football coach at the largest state school. This is actually a gross mischaracterization: Sometimes it is the basketball coach.

In fact in 40 of the 50 states, the highest-paid person runs a collegiate sports operation. The other ten are doctors running medical centers or, in a couple of places, college presidents.

Oh, but aren’t those people earning their money by bringing in the big bucks? Maybe; maybe not:

In 2011-2012, Mack Brown was paid $5 million to lead a mediocre 8-5 Texas team to the Holiday Bowl. The team still generated $103.8 million in revenue, the most in college football. You don’t have to pay someone $5 million to make college football profitable in Texas.

Just sayin.

(Oh, and what’s up with New Hampshire, where the guy making the most money coaches hockey?)

Nice to know our tech friends aren’t paying taxes

Since Mayor Ed Lee has decided that tech companies are the future of San Francisco, it’s nice to note that these outfits are often no better than the cheating robber barons of old — or the modern Leona Helmsleys. The Campaign for America’s Future notes that Apple dodged a $9.2 billion tax bill that would have been enough to cover most of the sequester cuts this spring. Notes Isaiah Poole:

Apple makes great products, but the obscenity of its use of the tax code to avoid paying its fair share for the functions of government that make its success possible is only exceeded by the tax code itself and the nexus of ideology and corporate greed that created it.

Only the little people pay taxes.

Is there hope for California?

Nothing cheers up an old tax-and-spend liberal than word that two major new sources of state revenue — enough to begin closing the gap in education funding — are at least on the table in Sacramento.

At the state Democratic Convention April 13, delegates approved a resolution calling for a split-roll property-tax system, removing commercial property from the protection of Prop. 13. There’s a group called Evolve working on this statewide, and Assemblymember Tom Ammiano has a bill that would end a loophole that allows corporations to buy and sell property without reassessment.

And now there’s also a campaign gearing up to establish an oil severance tax — something that every other oil-producing state already has. As oil and gas companies try to create a new oil rush in California, fracking their way to billions, the public ought to get a little something. After all, the oil below the ground belongs, in a sense, to all of us, not just to the companies that can stick a pipe into it.

Meanwhile, organized labor is attacking the Enterprise Zone Tax Credit, which is basically a corporate giveaway.

Not all of this is going to happen this year. Even with the overwhelming Democratic majorities in both houses, tax reform is tough; there are armies of lobbyists who will fight it all the way. And any ballot measure would need serious deep-pocket funding, since the California Chamber of Commerce, the real-estate industry and Big Oil would pour tens of millions in to defeating it.

Still: You have to start somewhere, and five years ago, none of this would have even been under discussion. So maybe there’s hope for California after all.

They will argue over the ownership of the corn that has sprung up on the banks of a drowned town, and which may spell environmental disaster for the nature preserve surrounding it. In this fight Tim and Nod are in uneasy, ultimately disastrous alliance with activist Callie (Crittenden), whom Nod distrusts and with whom Tim is hopelessly smitten. The result is a convoluted plot and a fitful production (co-directed by Walker and Misha Hawk-Wyatt) in which a three-pronged story precariously balances the fairy tale, the romance, and the legal battle. It’s the last prong that offers the more interesting if formulaic scenes, in which the politics of GMOs mesh with the swashbuckling machinations of the attorneys. But the less compelling strands converge and take precedence, forcing things down a sentimental and forgettable road. (Avila)

reasons to be pretty San Francisco Playhouse, 450 Post, Second Flr, SF; www.sfplayhouse.org. $30-100. Tue-Thu, 7pm; Fri-Sat, 8pm (also Sat, 3pm). Through May 11. Completing a trilogy of plays about body awareness and self-image (along with The Shape of Things and Fat Pig), Neil LaBute’s reasons to be pretty begins with a misconstrued remark that quickly gathers enough weight and momentum to tear three sets of relationships apart in the span of a two-hour play. The SF Playhouse production begins with a bang, or rather an awesomely knock-down, blow-out breakup fight between a righteously pissed-off Steph (Lauren English) and her awkwardly passive boyfriend Greg (Craig Marker), who has inadvertently referred to her as “regular” in a conversation with his jerkish buddy Kent (Patrick Russell), which she takes to mean he finds her ugly. English’s Steph is at turns ferocious and fragile, and her comic timing as she eviscerates Greg’s looks in a mall food court zings, while the hyperkinetic Russell elevates the condition of noxiously irredeemable douchebag to an artform. But terrific acting and polished design can only make up so much for a script that feels not only flawed, barely scratching the surface of the whys and wherefores each character has internalized an unrealistic view of the importance of conventional beauty standards, but also already dated, with its circa-2008 pop culture references. Ultimately it gives the impression of being a rerun of a Lifetime television drama that wraps itself up into a too-neat package just in time for the final credits to roll to its admittedly kickass soundtrack (provided by Billie Cox). Sex and the City: LIVE! Rebel, 1760 Market, SF; trannyshack.com/sexandthecity. $25. Wed, 7 and 9pm. Open-ended. It seems a no-brainer. Not just the HBO series itself — that’s definitely missing some gray matter — but putting it onstage as a drag show. Mais naturellement! Why was Sex and the City not conceived of as a drag show in the first place? Making the sordid not exactly palatable but somehow, I don’t know, friendlier (and the canned a little cannier), Velvet Rage Productions mounts two verbatim episodes from the widely adored cable show, with Trannyshack’s Heklina in a smashing portrayal of SJP’s Carrie; D’Arcy Drollinger stealing much of the show as ever-randy Samantha (already more or less a gay man trapped in a woman’s body); Lady Bear as an endearingly out-to-lunch Miranda; and ever assured, quick-witted Trixxie Carr as pent-up Charlotte. There’s also a solid and enjoyable supporting cast courtesy of Cookie Dough, Jordan Wheeler, and Leigh Crow (as Mr. Big). That’s some heavyweight talent trodding the straining boards of bar Rebel’s tiny stage. The show’s still two-dimensional, even in 3D, but noticeably bigger than your 50″ plasma flat panel. (Avila)

Steve Seabrook: Better Than You Marsh San Francisco, 1062 Valencia, SF; www.themarsh.org. $15-50. Thu, 8pm; Sat, 8:30pm. Extended through May 18. Self-awareness, self-actualization, self-aggrandizement — for these things we turn to the professionals: the self-empowerment coaches, the self-help authors and motivational speakers. What’s the good of having a “self” unless someone shows you how to use it? Writer-performer Kurt Bodden’s Steve Seabrook wants to sell you on a better you, but his “Better Than You” weekend seminar (and tie-in book series, assorted CDs, and other paraphernalia) belies a certain divided loyalty in its own self-flattering title. The bitter fruit of the personal growth industry may sound overly ripe for the picking, but Bodden’s deftly executed “seminar” and its behind-the-scenes reveals, directed by Mark Kenward, explore the terrain with panache, cool wit, and shrewd characterization. As both writer and performer, Bodden keeps his Steve Seabrook just this side of overly sensational or maudlin, a believable figure, finally, whose all-too-ordinary life ends up something of a modest model of its own. American Conservatory Theater presents the world premiere of Byron Au Yong and Aaron Jafferis’ musical (sung in English with Chinese supertitles) about a Chinese immigrant trapped in a Bronx elevator for 81 hours.

Tinsel Tarts in a Hot Coma: The Next Cockettes Musical Hypnodrome, 575 10th St, SF; www.thrillpeddlers.com. $30-35. Thu-Sat, 8pm. Through June 1. Thrillpeddlers and director Russell Blackwood continue their Theatre of the Ridiculous series with this 1971 musical from San Francisco’s famed glitter-bearded acid queens, the Cockettes, revamped with a slew of new musical material by original member Scrumbly Koldewyn, and a freshly re-minted book co-written by Koldewyn and “Sweet Pam” Tent — both of whom join the large rotating cast of Thrillpeddler favorites alongside a third original Cockette, Rumi Missabu (playing diner waitress Brenda Breakfast like a deliciously unhinged scramble of Lucille Ball and Bette Davis). This is Thrillpeddlers’ third Cockettes revival, a winning streak that started with Pearls Over Shanghai. While not quite as frisky or imaginative as the production of Pearls, it easily charms with its fine songs, nifty routines, exquisite costumes, steady flashes of wit, less consistent flashes of flesh, and de rigueur irreverence. The plot may not be very easy to follow, but then, except perhaps for the bubbly accounting of the notorious New York flop of the same show 42 years ago by Tent (as poisoned-pen gossip columnist Vedda Viper), it hardly matters. The Arsonists Aurora Theatre, 2081 Addison, Berk; www.auroratheatre.org. $35-60. Tue and Sun, 7pm (also Sun, 2pm); Wed-Sat, 8pm. Through May 12. There’s a lot of humor to be found in Alistair Beaton’s crackling translation of Max Frisch’s The Arsonists, playing now at the Aurora Theatre, but much of the laughter it elicits is of the nervous variety, as the play’s mostly protagonist, the effete, bourgeois Herr Biedermann (Dan Hiatt) inadvertently signs off on his own destruction when he invites an uncouth arsonist to come and stay in his attic (Michael Ray Wisely). “If we assume everyone is an arsonist, where does that get us?” becomes his standard deflection, as one arsonist becomes two (adding in the unctuous, nihilistic Tim Kniffin), and the empty attic a repository for giant drums of gasoline, a detonator, and fuse wire — arousing the suspicions of a chorus of firefighters (Kevin Clarke, Tristan Cunningham, Michael Uy Kelly), who act as the conscience and guardians of the township. Although on the surface the scenario is patently absurd, the message that passivity in the face of evil is like helping to measure out the fuse wire that will eventually claim your life, is relatively clear. “Not every fire is determined by fate,” point out the firefighters right in the first act. Hiatt, as Biedermann, strikes an admirable balance between loathsome and powerless, while Gwen Loeb shines as his socialite wife, Babette, as does Dina Percia as his agitated housemaid, Anna. The Coast of Utopia: Voyage & Shipwreck Ashby Stage, 1901 Ashby, Berk; www.shotgunplayers.org. $20-35. Shipwreck runs Wed-Thu, 7pm; Fri-Sat, 8pm; Sun, 5pm. Through May 5. Voyage runs Sat/20, April 27, and May 4, 3pm. Last year in the Shotgun Players’ production of Voyage, the first part of Tom Stoppard’s The Coast of Utopia trilogy (also playing in repertory through May 4), we were introduced to a tight circle of Russian thinkers and dreamers, chafing against the oppressive regime of Nicholas I. In the second part, Shipwrecked, we find them older, perhaps wiser, struggling to keep their revolutionary ideals alive while also juggling familial concerns and personal passions. Focused mainly on Alexander Herzen (Patrick Kelley Jones) and family, Shipwrecked travels from Russia to Germany, France, Italy, and the English Channel, buffeted from all directions by the forces of the uprisings and burgeoning political consciousness of the European proletariat. It’s an unwieldy, sprawling world that Stoppard, and history, have built (made somewhat more so by the Shotgun production’s strangely languid pace during even the most dramatic sequences) but it’s worth making the effort to spend time absorbing the singular world views of Russian émigré Herzen, his impulsively passionate wife Natalie (Caitlyn Louchard), the cantankerous, influential critic Vissarion Belinsky (Nick Medina), professional rabble-rouser Michael Bakunin (Joseph Salazar) and up-and-coming writer Ivan Turgenev (Richard Reinholdt) as they desperately seek to carve out both their personal identities and a greater, cohesive Russian one from the imperfect turmoil of Western philosophy. A spur to thought, to reading, to listening, to sparring over the meaning and magnitude of art — they’re all there in the brilliantly expansive, acute, and sometimes barbed observations of professor Vladimir Nabokov (a delighting, animated John Mercer), as he expounds on the subject of Russian literature in this simply staged but witty, well-honed dramatic reading from First Person Singular and adapter-director Joe Christiano. Presented as part of Shotgun’s Monday night Cabaret series, The Divine Game, drawing verbatim on Nabokov’s Cornell lectures of the 1950s, is an invitation to a heady walk down several byways in the land of great literary art, and there are few more discerning or inspiring guides whether or not you share in every conclusion about the relative merits and demerits of Chekhov (Joshua Han) or Dostoyevsky (Brian Quackenbush) — both of whom appear onstage alongside their idiosyncratic peers Gogol (Colin Johnson) and Tolstoy (Jess Thomas). There’s a frisson of mental joy in a distillation like, “Chekhov’s books are sad books for humorous people,” or the sweet-talking yet penetrating pronouncement that, “Of all the great characters that a great artist creates, his readers are the best,” and their cumulative impact over the course of 90 minutes offers enough inspiration for several reckless bookstore sprees. UPDATED Rival teams have formed in the last week to support and oppose the proposed Warriors Arena at Piers 30-32 as the California Legislature considers a new bill to approve the project, a new design is about to be released, and a trio of San Francisco agencies prepares to hold informational hearings.

Fresh off the collapse of two of the city’s biggest development deals, Mayor Ed Lee and his allies are pushing hard to lock in what he hopes will be his “legacy project.” A new group of local business leaders calling itself Warriors on the Waterfront held a rally on the steps of City Hall today, emphasizing the project’s job creation, community partnerships, and revitalization of a dilapidated stretch of waterfront.

That launch event followed last week’s creation of the San Francisco Waterfront Alliance, made up mostly of area residents and environmental organizations that oppose the project, including the Sierra Club and Save the Bay. The group today released a press release and artist’s rendering of how the 13-story arena and two condo towers may block views of the bay.

Last week, SFWA put out a press release criticizing Assembly Bill 1273 by Assembly member Phil Ting, claiming it would allow the project to avoid scrutiny by the Bay Conservation and Development Commission, which oversees and issues permits for waterfront projects. “One of the primary reasons we have regulatory agencies like the BCDC is so that local jurisdictions don’t run roughshod over the Bay and the waterfront,” group President Gayle Cahill said in the release. “The San Francisco Waterfront Alliance strongly believes that BCDC should retain its jurisdiction in this project to ensure independent oversight for the Bay and for all of us.”

Yet Ting and supporters of the project say the legislation doesn’t change BCDC’s oversight of the project, pointing to language that explicitly acknowledges the agency’s authority. While the legislation would remove the need for the three-member State Lands Commission to approve the project, proponents said approval by the full Legislature is a higher bar that ensures more public scrutiny and accountability.

“It does not waive BCDC. It goes through the same BCDC process,” Ting told us. “By going through the Legislature, you do have more hearings and public process. The idea was to make this more thoroughly vetted.”

The Port’s Brad Benson told us that State Lands staff is also still actively scrutinizing the project. “We’ve been working closely with State Land and BCDC staff to incorporate their concerns,” Benson said. For example, the arena configuration has already been moved closer to shore than originally proposed because of BCDC concerns about maritime access to a deep-water berth at the site.

In addition to approval by the Legislature and BCDC, the project must also be approved by the Port Commission and Board of Supervisors. The latest design for the project is scheduled to be released on May 6 and will be discussed by the Board of Supervisors Land Use and Economic Development Committee that day, said Gloria Chan of the Mayor’s Office of Economic and Workforce Development. The Planning Commission will then hold an informational hearing on the new design May 9, following by a May 14 hearing before the Port Commission. 

The project is proposed to include a 17,500-seat arena that would host more than 200 Warriors games, concerts, and other events per year, starting in 2017, on 13 acres of rebuilt piers. The adjacent, 2.3-acre Seawall Lot 330 would include up to 130 new condos, a hotel of up to 250 rooms, and 34,000 square feet of restaurants and retail space.

The whole project would include just 830-930 parking spaces, making its still-unfolding transportation plan key to the project’s approval. Opponents of the project also criticize the project’s height and its financing package and say this intensive development isn’t consistent with city plans or state laws that protect waterfront lands for maritime and public uses.

“We told the mayor before it was even announced that it is not a legal use of the pier,” Save the Bay Executive Director David Lewis told the Guardian. “There’s no reason that an arena has to be out on the water on a crumbling pier.”

Yet proponents tout the project’s economic benefits to the city and the need for an arena that size to host concerts and conventions, beyond the prestige of luring the Warriors away from Oakland and back to its original home city. “It will be privately financed and turn a crumbling pier and unsafe parking lot into a state-of-the-art venue that generates new revenue for the region and provides a spectacular new facility for the Bay Area’s NBA team.”Jim Wunderman, CEO of the Bay Area Council and an honorary co-chair of Warriors on the Waterfront, said in the press release.

UPDATE: Rudy Nothenberg, who served five SF mayors financing big civic projects and helped found SF Waterfront Alliance, disputes several assertions made by project proponents. “The first version of [AB 1273] unquestionably moved BCDC out of the way,” he said, claiming that bill language was altered after input from BCDC and the consultant to the Assembly Natural Resources Committee. BCDC has not yet returned a call from the Guardian on the issue. Nothenberg also says AB 1273 turns the deliberate fact-finding process required for the State Lands Commission to make its public trust determination into a political process that is a less thorough vetting of the project.

He also took issue with the statements by Wunderman and others that this is a privately funded project, noting that taxpayers will be paying $120 million to rebuild these piers and will give up future property taxes on the site, which will be diverted by a special tax district to help repay the bonds. Nothenberg told us, “Their continued assertion that there is no public money involved in blatantly untrue.”

 

When conservatives love Leno

State Sen. Mark Leno is used to facing opposition. His efforts to regulate chemicals, end gender discrimination in insurance, and force cell-phone makers to come clean about radiation levels put him up against some of the most powerful interest groups in the state. He’s fought with Republicans over state spending and taxes.

He’s not used to getting support from right-wing media.

Yet that’s what’s happening now: In an odd political reversal, Leno’s (eminently reasonable) bill to allow cities to explore extending drinking hours is getting flak from progressive groups like Alcohol Justice — and support from the Orange County Register and Fox News.

The Register, which hates all forms of regulation, ran an editorial endorsing Leno’s bill on the grounds that it makes perfect sense for a world where people no longer always work 9-5. (Oh, and it makes sense because there are two many damn laws anyway and we should let people drink when they want.)

Neil Cavuto of Fox News interviewed Leno recently, and his only complaint about the bill was that the procedure for actually getting a late-hours license would be so complicated that even hearing about it was driving him to drink.

That’s the thing: Leno’s bill doesn’t force anyone to do anything. It just sets up a long, complicated process that might, in the end, after extensive public input on the state and local level, allow a couple of bars in a few limited areas (in cities that want to pursue this) to stay open until 4am, as bars in many civilized states already do.

So while Bruce Livingston, who is a decent guy and usually works on good issues, is running around the state trying to get progressives to oppose the Leno bill, the conservatives who usually vote against everything Leno does might wind up on board.

And wouldn’t that be an odd way to get a good bill passed?

 

 

Checks from mayor’s mysterious breakfast companions mysteriously absent

In less than three months, custom made super yachts will zip around the San Francisco Bay in the ultimate competition for the prized America’s Cup. But San Francisco could wind up spending millions more than originally expected to host this prestigious sailing regatta.

At a March 13 committee hearing at the Board of Supervisors, America’s Cup Organizing Committee CEO Kyri McClellan reported that Mayor Ed Lee was investing an “incredible amount of energy” into helping ACOC with fundraising efforts to avert a city funding shortfall. He was even said to be hosting “breakfasts with CEOs” to solicit funding, McClellan said.

Who are the CEOs? Nobody will say.

How much has each of them pledged to give? Nobody will say.

When the Guardian submitted these questions to Lee, McClellan, and Stefanie Roumeliotes – whose SGR Consulting firm was wheeled in at the last minute to organize fundraising events – none answered directly.

McClellan responded on April 9 with a copy of a letter she sent to Mayor Lee and Board President David Chiu on the day of the hearing, which she indicated was “the most recent update on fundraising.” Roumeliotes, for her part, told the Guardian flat out to stop calling, because her firm was not going to answer any questions.

So far, it appears that none of the mayor’s fundraising meetings, which took place from January 25 to March 4, resulted in his unnamed breakfast companions writing out actual donation checks.

Had they contributed funding, the donation amounts would have been reflected in “behested payment” forms filed with the San Francisco Ethics Commission, required under state law to be submitted 30 days after a contribution is made.

Elected officials are “supposed to file behested payment [forms] for … legislative, governmental or charitable purposes,” Ethics Commission chief John St. Croix told the Guardian, so donations relating to the America’s Cup would fall squarely into this category. Those forms are supposed to filed internally by department, then sent onto Ethics. So far, none have been recorded.

“If there are such forms that the mayor filled out,” St. Croix told the Guardian, “they’re not getting forwarded.”

Meanwhile, McClellan’s March 13 letter suggests that recent fundraising efforts have yielded only $1.4 million – which won’t actually be in hand till next year. That’s a far cry from the estimated $15.6 million funding gap race organizers say is needed to cover San Francisco’s estimated $22.5 million billionaires’ boat race tab. As the fundraising arm of the race organizing committee, ACOC promised in an initial agreement that it would “endeavor to raise” the amount needed to defray city costs. Thus far, it’s paid $6.8 million.

In her letter to Lee and Chiu, McClellan suggested that roughly $13 million of that $15.6 million shortfall would be accounted for in “forecast General Fund revenues.” That translates to additional money harvested from visitors’ pockets via sales and hotel taxes, with some payroll taxes and parking fees sprinkled in, all associated with the America’s Cup events. Little-guy money.

And thanks to the little guys, ACOC’s new fundraising goal is much more attainable. “The SFACOC continues to endeavor to raise the funds,” McClellan wrote. “At a minimum that is $2,670,851 of which we already have $1,400,000 in existing pledges that are to be received by January 2014.”

 

WTF, Chuck: Repeal the bottle bill?

Now, I thought we were all going to have to pay money to read the wisdom of C.W. Nevius, but here it is, for free, right on sfgate: Nevius is calling on California to repeal the “bottle bill,” the measure that requires a (modest) deposit on cans and bottles and that has been widely credited for making this one of the leading places in the world for recycling.

His argument: People are stealing recyclable material and selling it. This leads to drugs. (Seriously, this leads to drugs: “It hurts everybody,” says Adam Alberti, a spokesman for Recology, the city’s garbage collection firm. “We have heard reports of (scavengers) being paid in drugs instead of cash.”)

And, of course, criminal syndicates that underpay desperate people. The old Haight Asbury Recycling Center, which Chuck hated so much, demonstrated how the syndicate racket doesn’t have to work, since small-time individual bottle-pickers could get there without a truck and keep all the money. Oh, but that was also leading to drugs. So now it’s gone. Amazing, Chuck, the law of unintended consequences.

Anyway: Criminal syndicates aren’t a good thing. Wall Street, for example. Certain landlords and businesses that prey on the weak and don’t pay their taxes. Or the people who cheat their low-wage trash-diving workers.

But on the scale of all the things wrong in the world, and the city, this has to be pretty small-time. Because the bottom line for me is this:

The stuff is getting recycled.

That’s what we want, right? We don’t want bottles and cans in a landfill. From a strictly environmental viewpoint, it makes no difference if Recology picks the stuff up and makes money off it, or if a poor person picks up the stuff and makes money (except not in the Haight any more) or if some explotive syndicate hires people to pick the stuff up. It gets to the same place.

Again: Not supporting the criminal syndicates. Their workers should get fair pay, like all workers. Still, repealing the bottle bill seems like a pretty crazy way to address this modest problem.

 

 

Norquist exposes tax avoiders

I’m not a big fan of Grover Norquist, who will be in town April 4 and who is so against taxes that he apparently would have refused to pay his share of the cost of World War II (back when the government actually asked taxpayers to pay for wars as they were being fought, instead of pretending they were free and borrowing money that future generations will have to repay). Michael Krasny, the host of Forum, had Norquist on April 2 and didn’t ask the guy if he would have cut the taxes used to fight the Axis Powers (there was even an “excess profits tax” on corporations during the war years).

But they did have some interesting back and forth about taxes, and Norquist made an interesting observation, one that I actually agree with. (Yes, trolls — I have found myself agreeing with Grover Norquist.)

Krasny asked him about the pledge that Bill Gates and Warren Buffett made to give away half of their wealth before they did. Krasny seemed to think this was a great thing. Norquist was fine with it, too, but he put it in context:

What the great philanthropists are actually doing is avoiding the estate tax.

By giving away their money to causes they choose, Gates and Buffett will prevent the US government from collecting taxes on that money when they die — meaning, in effect, that the very rich who go along with this plan are saying they would rather they choose the beneficiaries of their largesse than allow the elected officials who represent the public to have a hand in redistributing the wealth.

That’s the thing about philanthrophy — it’s a fine, of course, but it’s also a way for the very rich to decide what they want to fund — and in many cases we’re talking about museums and universities, not homeless shelters and indigent mental-health programs.

If we taxed Gates and Buffett at a reasonable level (and even Buffett says his taxes are way too low), then we might not be looking at cuts to in-home support services and other life-saving programs that the government “just can’t afford” these days. (Of course, if we hadn’t spent $2 trillion and counting on wars in Iraq and Afghanistan — or if we’d raised taxes to the level needed to pay for those wars, which would have meant an end to them, we wouldn’t be in such a deep fix anyway.)

 

Time to enforce the law

EDITORIAL The new tech companies that are making waves in San Francisco — Airbnb in the short-term rental business and Lyft and Uber in the taxi industry — may describe themselves as innovative and disruptive, and they may be appealing to investors.

But there’s a more accurate word that describes their relationship to the city:

Cheaters.

The way these companies are luring customers isn’t really about high-tech applications or brilliant business models. They’ve just found a way to get around the rules that everyone else has to obey.

Some city officials are talking about hearings and new legislation, all of which is fine. But in the rest of the business community, when someone flagrantly, openly violates the regulations, the City Attorney’s Office cracks down. That’s what needs to happen here, and soon.

Airbnb has a slick and appealing promise: You can rent out your house or apartment on the Internet to someone who wants to stay in the city for a few days, but is looking for an alternative to a traditional hotel. The homeowner or tenant gets some extra bucks; the visitor gets to stay in a cool neighborhood at a bargain price. What’s not to like?

Well, for one thing, most leases in San Francisco bar unauthorized sublets, so renters who offer their places on Airbnb face problems with their landlords, including possibly eviction. City laws also bar the use of residential property for commercial purposes. And, as we’ve pointed out repeatedly, Airbnb isn’t collecting the transient occupancy tax that every other hotel operator in the city has to pay. The total tab: At least $1.8 million a year.

Lyft and Uber say they’re using creative apps to offer an alternative to the screwed-up taxi system. Drivers offer rides to people who can “volunteer” to pay at the end — but if nobody pays, the whole business model fails and the venture capitalists who put up the money lose. So everyone knows that these are pay-for-hire taxis.

Except that San Francisco requires every taxi driver to have a permit, called a medallion — and drivers have to go through training, background checks, and carry extensive insurance. If a driver overcharges or refuses a fare, a customer can complain to the city, and get recourse. The startups don’t follow the same rules.

There are reasons the city regulates cabs and charges hotel taxes. Cab drivers are ferrying people, some of them vulnerable; it’s only a matter of time before a rogue driver who sneaks into the new unregulated startups winds up in a horrible crash or criminally preying on riders.

Driving a cab without a medallion is illegal. Failing to pay city taxes is, too. City Hall can debate and dither and try to avoid offending the mayor (who, unfortunately, is trying to help Airbnb slide). But this is a clear-cut case of businesses flouting city law. Herrera needs to put an end to it.

 

GOP ‘dark wizard’ and Occupy ‘anti-leader’ to speak in SF on the same day

This coming Thursday, a central intellectual figure of the Occupy Wall Street movement will give a talk on “Austerity and its Discontents.” And across the city, at the very same time, powerful anti-tax lobbyist Grover Norquist will mix it up with an elite group of San Francisco Republicans (yes, they really do exist).

Graeber, an American anthropologist and anarchist who teaches at Goldsmiths, University of London, was dubbed “the anti-leader of Occupy Wall Street” in a Bloomberg BusinessWeek Magazine article published shortly after a determined band of committed activists staked a claim on Manhattan’s Zuccotti Park, kicking off the global Occupy movement. Graeber’s tome on wealth inequality, Debt: The First 5,000 Years, recounts the ages of human history through the lens of the indebted, vis-à-vis their creditors. The book helped give rise to Occupy activists’ famous chant: “We are the 99 Percent!”

Norquist hails from the polar opposite end of the political spectrum. An influential lobbyist who leads Americans for Tax Reform, he was once described as “the dark wizard of the Right’s anti-tax cult,” in the words of Arianna Huffington. The fiery conservative is most well known for his role as keeper of “the Pledge,” which essentially asks Republican lawmakers to swear that they will never, ever vote to raise taxes for any reason. 

The Thursday meet-and-greet, billed as “Cocktails with Grover Norquist,” is being hosted by the San Francisco Republican Party – a political body that barely registers as a blip as far as local elections are concerned, but apparently has enough clout to make it worthwhile for a famed operative like Norquist, whose group is based in D.C., to dip into San Francisco for a visit. The cocktail hour will be held at The City Club, a financial district venue. It costs $100.

Just as San Francisco Republicans sip cocktails and discreetly await the chance to engage Norquist in a few moments of powerful face-time, an audience of lefties will gather to hear Graeber’s studious analysis of global austerity measures and anarchist organizing tactics. Billed as a forum that’s free and open to the public, Graeber’s talk is being hosted by the Anthropology and Social Change Department of the California Institute for Integral Studies, located at 1453 Mission Street.

In a recent interview about the round of national budget cuts known as the sequester, Norquist told The Daily Beast: “I’m for the spending cuts. Just let them take effect. … The only thing worse than the sequester would be not reducing spending.”

And here’s Graeber’s take on the underlying economic climate that gave rise to the Occupy movement: “It’s becoming increasingly obvious that the real priority of those running the world for the last few decades has not been creating a viable form of capitalism, but rather, convincing us all that the current form of capitalism is the only conceivable economic system, so its flaws are irrelevant. … The economic crisis of the 1970s never really went away. It was fobbed off by cheap credit at home and massive plunder abroad – the latter, in the name of the ‘third world debt crisis.’ But the global south fought back. … The debt crisis has come home to Europe and North America, replete with the exact same approach: declare a financial crisis, appoint supposedly neutral technocrats to manage it, and then engage in an orgy of plunder in the name of ‘austerity.’”

Airbnb’s tax and tenant law violations headed for hearings

As Airbnb continues to avoid making any public comment on the $1.8 million annual Transient Occupancy Tax obligation to the city that it appears to be dodging, with the complicity of the Mayor’s Office, Board of Supervisors President David Chiu is getting closer to introducing legislation to regulate so-called “shared housing” and holding public hearings on the issues it raises.

In addition to the tax issue, there are concerns that Airbnb, VRBO.com, and other Internet-based sites that facilitate short-term rentals of San Francisco apartments are increasingly being used to circumvent local tenant protections, often after evicting tenants from the apartments using the Ellis Act. That state law allows owners to leave the rental business and convert to other uses, and landlords can argue that Airbnb is a commercial use and not a residential use.

“I’ve been deep into a lot of these issues in my conversations with a lot of community stakeholders around Airbnb and the area of shareable housing and I’m hoping very soon to have a package of proposals in this area. And at that point, we’ll have public hearings on the topics that you describe,” Chiu told us when we asked about the tax and tenants issues.

Among those involved in Chiu’s negotiations with Airbnb is Ted Gullicksen, executive director of the San Francisco Tenants Union, who says the negotiations have been slow-going but he’s generally happy with how they’re proceeding and hopeful that the resulting legislation will rein in rampant current abuses of zoning, tax, and other regulations that city officials have been ignoring.

“All you have to do is sit in front of the computer for a few hours and you can identify a lot of the lawbreakers. But there’s no enforcement by the city,” he said, noting that the Tax Collector’s Office is the notable exception among city departments, such as the Planning and Building departments. “The taxes shouldn’t even be an issue because they’re illegal uses.”

For example, while landlords may be able to get around rental restrictions triggered by an Ellis Act eviction by calling the use for shared housing websites “commercial,” that’s usually a violation of local planning codes prohibiting commercial use of residential property. Chiu’s legislation approved late last year banning “hotelization,” in which entire apartment buildings are cleared of tenants and rented out on a short-term basis, allows nonprofit groups like the Tenants Union to help enforce the ban.

“We’ve been researching the buildings we want to go after with complaints and lawsuits,” Gullicksen said. “It’s a pretty widespread problem.”

He said the VRBO.com appears to be a bigger culprit in terms of being used by landlords to avoid tenant protections than Airbnb, whose hosts are evenly split between tenants and landlords. But as the biggest shared housing service in San Francisco, the tax issues are bigger for Airbnb and the city.

“We don’t mind the limited use of someone’s principal residence for short-term rental, where we’re concerned is about the whole buildings,” Gullicksen said.

Whether the issue is avoiding taxes or circumventing tenant protections, the complicated issues surrounding shared housing are long overdue for some public discussions and scrutiny, and it sounds like that’s what we’re see later this spring or summer.

The right wing and same-sex marriage

I had lunch with my old friend Johnny Angel Wendell, a musician, actor, and radio personality in LA, who was up here on vacation (and to hype his new vinyl, “My Lesbian Friend,”) and we got to talking about the Supreme Court and same-sex marraige, and Johnny and I have agreed for years that this debate is essentially over. When 80 percent of people under 30 think same-sex marriage is fine, then it’s really only a matter of time before it’s legal and encouraged in every single state.

Johnny knows a lot of folks in talk radio, and a lot of them are on the right-wingy side of things, so he’s a dinosaur watcher, and he had this suggestion: The reason the right wing is all agitated about same-sex marraige, and really wants the Supreme Court to avoid saying that Prop. 8-style laws are all unConstitutional, is that these folks are starting to run out of divisive social issues. The “god, guns, and gays” approach doesn’t have the power it once did — and once that stuff goes away, then they’ll have to start talking about economic issues — where they will always lose.

Thomas Frank figured that out in What’s the Matter with Kansas — social issues have been driving working-class Americans to vote against their economic interests. Imagine if the next generation doesn’t care about gay marriage at all; then maybe those voters will think about taxes and wealth inequality and corporate power. And for a certain segment of American politics, that’s really frightening.

 

Reagan’s legacy: Homeless death

The headline on sfgate is about as brutal as you can get: “The coming homeless die-off.” But the brief story points to an alarming set of statistics: The median age of homeless people on the streets of US cities is now 53. The life expectancy for homeless people is 64. You get the point.

But here’s the key political element:

Social scientists say the median age has been steadily increasing for many years, supporting the “big bang” theory that many of today’s street people hit the gutter back in the 1980s era of recession and slashings of social programs.

Having lived through the Reagan Era, and worked with homeless people in the early 1980s at the Haight Ashbury Switchboard, I can tell you that makes perfect sense. Vast libraries of books have been written about the Reagan Era, but one of the things it represented was the end of major federal support for low-cost housing in cities — and the end of any concept of linking welfare payments to the cost of housing.

There were a lot of people living on General Assistance and SSI in San Francisco in the late 1970s, and most of them had homes. That’s because public assistance programs provided enough income to cover the rent on a cheap place. Between GA and food stamps, people who were, for whatever reason, unable to work wound up in crappy apartments and sometimes crappier SROs, but they weren’t on the streets.

Yes: Some of those people had serious substance-abuse issues. Yes: SSI and GA checks were going, in part, for drugs and booze. But even ignroing the notion that it’s much better for a drunk to have an SRO room than to be homeless, it’s also cheaper. San Francisco spends a fortune on homeless services, and if the feds (and the City and County) had indexed public assistance to the cost of housing (which happened pre-Reagan) the toll on the local taxpayers would almost certainly be lower.

So Reagan’s policies are now killing people on the streets of San Francisco. All these years later.

 

 

Fighting for patients, beyond the bedside

It’s no coincidence that the California Nurses Association has been the most active and effective union in fighting for a broad social and economic justice agenda, one that seeks to give greater value to caring and caregiving. Unlike many unions that fight mostly for their members’ interests, CNA is an extension of the nursing ethos itself.

“It’s not enough to advocate for patients at the bedside. We take it out into the streets and the community. That’s what nursing is,” Zenei Cortez, an RN of 33 years and co-president of CNA, told us. The CNA agenda has included support for increasing taxes on the wealthy to restore cuts to social services, advocacy for a single-payer healthcare system, affordable housing, and some of the best and sharpest opposition to the gubernatorial ambitions of Meg Whitman, who proposed deep cuts to state spending on education and other essential programs.

“We have a health care system that only cares about profits and nothing else,” said Chuck Idelson, who heads the communications staff that works for the nurses, “which is why you need people who value care over profit.”

And that’s the nurses, who have been growing in both numbers and political strength just as the healthcare profession has increasingly fallen under the sway of Wall Street and its values, making CNA an important political force.

“When I first started in nursing, we had a lot of time with our patients at the bedside,” Cortez told us. “But now, that human factor has disappeared.”

Nurses first began to flex their power early in Cortez’s career when “nurses were thought to be the handmaidens of doctors. But we were able to change that mentality,” one that was rooted in sexism and old domination-based models.

After the doctors, the nurses stood up to the healthcare corporations, winning statewide minimum patient care staffing ratios and contracts for themselves that gave them a stronger voice in patient care.
