Profiling those who rely on HANC, which the city is evicting (VIDEO)

The Haight Ashbury Neighborhood Council’s (HANC) Recycling Center has fought for the past decade to stay in its tiny corner of Golden Gate Park, behind Kezar stadium, and it may be days from closing. It’s been served with eviction notices from the city and weathered political tirades from politicians on pulpits, and most recently, saw its eviction appeal denied by California’s Supreme Court.

The recycling center, which has been in operation since 1974, wouldn’t be the only loss to the Haight either. Both a community garden and San Francisco native plant nursery are on the site, under the umbrella name of Kezar Gardens. After an eviction for the recycling center, all three would go.

So in what may be their last days, the Guardian decided to take a look at  who is a part of the recycling center’s community. What keeps them coming back – even in the face of eviction? While the final eviction date is nebulous, the reasons for it are not: as the Haight gentrified, more and more neighbors complained about the site’s surrounding homeless population, the noise the recycling center makes, and every other NIMBY complaint in the book.

Contrary to the usual complaints of the recycling center and gardens attracting numerous homeless people, the people detailed in the stories below reflect a diverse community. And there were far more stories that we didn’t include: the busy head of a nonprofit who gardens to keep his sanity, or the two brothers who bring in their recyclables every week as a way for their parents to teach them responsibility. And they’re not the only people who depend on the recycling center and gardens.

“One of the problems [with evicting HANC] is that the small businesses in the area depend on the service of the center,” Sup. Christina Olague, who representing the area, told us. “We don’t want to see it relocated out of the area.”

Olague said that although ideas for a mobile recycling center or a relocation have been batted around, nothing is concrete yet. The Mayor’s Office, the Recreations and Parks Department, and HANC were all going to have more meetings and try to come to a solution that would benefit all sides, she said.

The recycling center and gardens aren’t going down without their supporters making a clamor. They developed a feature documentary about their struggles, titled 780 Frederick. Directed by Soumyaa Kapil Behrens, the film will play at the San Francisco International Film Festivals “Doc Fest” on Nov. 11.

Until then, here’s a glimpse at some of the people who make up the community at the HANC Recycling Center and Kezar Gardens.

 

Greg Gaar, Native Plant Nursery Caretaker

Longtime groundskeeper and recycling guru Greg Gaar will soon be out of a job, only a year after single-handedly starting a native plant nursery in the Haight Ashbury that serves more than 100 people.

Gaar is the caretaker of the Kezar Garden nursery. He raises Dune Tansy, Beach Sagewort, Coast Buckwheat and Bush Monkey –  all plants originally born and bred from the dunes of old San Francisco.

“I do it because I worship nature, to me that’s god,” Gaar said. He spoke of the plants reverently.

The native plants aren’t as bombastically colorful as the rest of Golden Gate Park, he said, which Gaar calls “European pleasure gardens,” but they’re hearty and durable, like Gaar himself.

Gaar has a weathered face from years of working in the open air, and he grinned large as he talked about his plants. His grey beard comes down a few inches, giving him the look of a spry Santa Claus. Gaar has a history of embracing the counterculture, much like the Haight itself. In 1977, he made his first foray into activism.

At the time, wealthy developers in the city wanted to develop buildings and houses on Tank Hill, one of the few remaining lands of San Francisco with native growth. “Two percent of the city right now has native plants,” he said. It’s a travesty to him, but he did his part to prevent it.

Gaar led the charge against the redevelopers by putting up posters and flyers, and fighting them tooth and nail for the land through old fashioned San Francisco rallying.

In the end, the counterculture activists won, and the city of San Francisco bought the land back from the developers, keeping it for the public trust. The long-ago battle over Tank Hill was a victory, but the fight for the Haight Ashbury Recycling Center may already be lost.

Gaar has deep ties to the recycling center. Among his friends are two ravens, Bobbie and Regina, who recognize Gaar since the first time he fed them 16 years ago. Occasionally, he says, they’ll accompany him on his rounds around the park. The ravens aren’t the only friends he’s made through the recycling center.

They have many patrons looking to make a few bucks off of cans and bottles, many of which are poverty-struck or homeless. Gaar darkened as he spoke of them, because over the years he has lost many friends he’s made through work. The recycling center is a community, and those that are lost are often memorialized in the garden that Gaar grew with his own hands.

In the San Francisco Chronicle, columnist C. W. Nevius frequently calls out the nursery as a “last ditch effort” on the part of the recycling center to stave off closure and legitimize its own existence. In reality, the nursery was brainstormed years before the controversy through Gaar’s inspiration.

Though Nevius may not agree with the ethos Gaar has brought to the recycling center, the city of San Francisco must trust him. The Recreation and Parks Department has offered him a job planting native plants around Golden Gate Park, which is Gaar is welcome to after the recycling center closes. But taking care of native plants is more than a job to Gaar, it’s a calling.

“Isn’t it amazing that we exist on one of the sole planets we know of that supports life?” Gaar said with wide eyes. He sees his job as preserving the natural order, working to keep alive the plants that were part of the city before the first arrival of the spaniards.

Gaar, much like his plants, is part of a shrinking population of the city: the San Francisco native. When the recycling center closes, he’ll be able to spread native plants across Golden Gate Park, another rebel cause in a life of green activism.

 

Kristy  Zeng, loyal daughter

Kristy Zeng, 30,  talked about everything she does for her family in a matter of fact tone, as if none of it took effort, patience or loyalty.

As she talked, Zeng unloaded over six trash cans worth of recyclables into colored bins. At home, she has two young girls waiting for her, ages three and one, she said. The money she gets from the recyclables is small, but necessary – not for herself, but for her mother.

“My mom’s primary job is this one,” she said. Zeng’s mother is 62 and speaks no English. In the eight years she’s been in San Francisco since immigrating from China, she hasn’t been able to find a job.

“People look at her and say she’s too old,” Zeng said. “She’s too near retirement age.”

So Zeng’s mother hauls cans in her shopping cart every day to earn her keep. She’s one of the folks you can spot around town foraging in bins outside people’s homes, collecting recyclables from picnic-goers in parks, and asking for empties from local bars. The money she earns is just enough to pay for her food.

Even between her husband’s two jobs, Zeng said her family doesn’t have quite enough to fully support her mother. The recyclable collecting is vital income, Zeng said. She and her extended family all live in the Sunset and Outer Richmond, though she wishes they could find a place big enough to live together.

The Haight Ashbury Recycling Center is just close enough to make the chore worth the trip. Zeng was surprised to hear that the center was near closure.

“I would have to find a job,” she said. She usually watches her infant and toddler while her husband is at work. “Mom can’t babysit them, her back isn’t so good. It’s too hard.”

It’s not so bad though, she said, because at 30 years old, Zeng is still young and can handle the extra work. But if the recycling center closed, Zeng and her mom would both have to find a new way to make ends meet.

 

Steven and Brian Guan learn responsibility

At about five feet tall, wearing an oversized ball-cap and dwarfed by the man-sized jacket he wore, Brian Guan, 12,  definitely stood out at the Haight Ashbury Recycling Center. All around him, grisly old men hauled bins full of cans and bottles – but he didn’t pay them any mind.

Brian had his older brother Steven Guan, 14, to look out for him. Together they hauled in four bags worth of recyclables in plastic bags, walking straight to the empty bins as if it were a routine they’d done a dozen times before.

Which, of course, they had.

“I’ve been doing this for at least a year,” Steven said. Though he looks totally comfortable, the chore definitely introduced him to a different crowd than he’s used to.

The recycling center’s clientele of homeless folks, and people generally older than 14, don’t really bother him, he said. “It’s kinda weird, but it’s no big deal.” Besides, he said, he’s happy to help out his family, who spend a lot of time working.

“My mom works in a hotel, and she collects the cans and stuff there.” His dad does the same.

Their mom is a maid, and dad is a bellhop, working in separate hotels downtown. Steven didn’t know if the money they collect each week was vital for his family’s income, but he does know that the haul isn’t very much.

“It’s usually only like $10,” he said.

So was it even worth the trip? Steven said that if he wasn’t helping out his parents by bringing in recyclables, he’d probably be “at home doing nothing.” A Washington High School student, he doesn’t play on any sports teams and isn’t in any clubs. He spends the majority of his time helping out his family.

The way he figures it, he said, the chore is meant to teach him responsibility.

It looks like it worked.

 

Dennis Horsluy, a principled man

A lot of the patrons haul cans and bottles to the Haight Ashbury Recycling Center out of need: to feed themselves, clothe themselves, and live. Dennis Horsluy, 44, does not count himself as one of those people.

“It’s pocket change,” Horsluy said. But despite the cost, he’s going to get every red penny back from the government that he’s owed through the California Redemption Value charges on cans and bottles. “It’s just the right thing to do.”

Horsluy said that Sunset Scavenger, now known as Recology, has a stranglehold on San Francisco’s recycling and trash.

“If you leave your recyclables on the curb, it’s like taxation without representation,” he said. You pay for it whether you want to or not. In his own version of “sticking it to the man,” Horsluy makes sure his recycling dollars get back into his hands.

Horsluy is a displaced auto-worker who has only just recently found work again. “I made plenty, and now I make nothing,” he said.

A family man, he has a daughter at Lowell High School, and a son at Stuart Hall High School. He thinks San Francisco has problems much weightier than closing the recycling center, such as the school lottery system that almost had him sending his kids far across town for school.

Horsluy wasn’t surprised that some of the Haight locals had managed to finally oust the recycling center, considering they’ve been complaining for years about how it attracts many of the local homeless population to the area. “I’m sure it’s a problem for the neighbors with their million-dollar homes,” he said.

But the homeless were a problem long before the Haight Ashbury Recycling Center, Horsluy said. San Francisco has a history of generosity, and so it draws more of the needy. Horsluy will be fine without the recycling center, he said, but the more poverty stricken patrons of the center may not be.

“They’re just trying to survive.”

 

Chris Dye, gardening his troubles away

Some people drink to forget. Chris Dye, 44,  does something similar — he gardens to forget.

While watering the plot of greens he calls his own, Dye spun a yarn that sounded like a San Francisco version of a country song. His ex-wife bleeds his paychecks dry, and he had to leave his dream job at the National Parks Service to make ends meet in Information Technology, a job he pictures as the last place he’d like to be.

He regained a bit of peace in his ordeals through a hardcore passion for San Francisco native plants. “I found a rare kind of phacelia clinging to life in the cement at City College,” Dye said. “You know, down by the art building? When I saw it, I sketched it.”

A day later though it was gone, he said. He fell silent in what was almost a reverent moment for the rare native plant he spotted. Dye is on a personal mission to revive native San Franciscan plants.

The Kezar Gardens give Dye a chance to grow for himself all the interesting native plants he’s interested in. Inspired by the native plant nursery’s caretaker, Greg Gaar, he rattles off all the near-extinct species he’s been able to see and raise. “For me, it’s a personal experiment to figure all this out.”

It’s not all about leafy activism though. Sometimes, it’s just about a good meal. Dye snapped off a leaf and crushed it with his fingers. “This is Hummingbird Sage,” he said, holding it up to his nose for a sniff. “Mix this into a little olive oil, and rub it all over your pot roast, or whatever. It’s fucking amazing.”

 

Lael and Genevieve Dasgupta

Four-year-old Genevieve marched around the table by the garden, watching as a woman carves a pumpkin for Halloween.

Genevieve and her mother, Lael Dasgupta, recycle there in the Haight once a week, as part of Dasgupta’s hope to get her to learn at a young age about eco-responsibility. They don’t use one of the garden plots in the community garden, because they have a communal backyard at home. They do use some of Greg Gaar’s native plants in their garden, for decoration.

Dasgupta has mostly practical reasons for recycling. “It brings us about $40 to $50 a week… That’s a lot of money,” Dasgupta said.

But despite the location of several other recycling centers in the city, why does Dasgupta bring Genevieve here?

“Dirt, dirt dirt,” she said. “Its just good for her to play in the dirt, and build a healthy immune system. The other recycling centers aren’t as charming.”

Dasgupta said that if Kezar Gardens and the Haight Ashbury Recycling Center were to close, she wouldn’t relish taking her daughter out to the Bayview recycling center. She’s been there, and didn’t enjoy the experience. It’s easy to see that the two are comfortable at Kezar Gardens. Folks around the gardens all seem to know Genevieve, who marches around the place without fear.

The woman who was carving the pumpkins handed one to Genevieve for her to play with. The young girl promptly set to the pumpkin with a marker, making what could be either a set of incomprehensible squiggly lines, or the Milky Way galaxy, depending on your perspective.

BEHIND THE MIRKARIMI CASE

In early January, details from the police investigation of then-Sheriff-elect Ross Mirkarimi bruising his wife’s arm during an argument were leaked to the San Francisco Chronicle and other news outlets. The key piece of evidence was a 45-second video that Mirkarimi’s wife, Eliana Lopez, made with her neighbor, Ivory Madison, displaying the bruise and saying she wanted to document the incident in case of a child custody battle. That video convinced many of Mirkarimi’s guilt, and a majority of Ethics Commissioners say they found it to be the main evidence on which Mirkarimi should be removed from office on official misconduct charges (the Board of Supervisors was scheduled to vote on Mirkarimi’s removal on Oct. 9, after Guardian press time).

But that video was only a small part of the overwhelming and expensive case that Mayor Ed Lee brought against Mirkarimi, including the more serious charges of abuse of power, witness dissuasion, and impeding a police investigation, all of which go more directly to a sheriff’s official duties. All of those charges got lots of media coverage and they helped cement the view of many San Franciscans that Mirkarimi engaged in a pattern of inappropriate behavior, rather than making a big momentary mistake. Yet most of the media coverage during the six months of Ethics Commission proceedings ignored the fact that none of the evidence that was being gathered supported those charges. Indeed, all those charges were unanimously rejected by the commission on Aug. 16, a startling rebuke of Lee’s case but one that was not highlighted in many media reports, which focused on the one charge the commission did uphold: the initial arm grab.

 

 

THE NEXT DOT-BOMB

In the late 1990s, San Francisco was in a very similar place to where it is now. The first dot-com boom was full bloom, driving the local economy and creating countless young millionaires — but also rapidly gentrifying the city and driving commercial and residential rents through the roof (great for the landlords, bad for everyone else). And then, the bubble popped, instantly erasing billions of dollars in speculative paper wealth and leaving this a changed city. The city’s working and creative classes suffered, but the political backlash gave rise to a decade with a progressive majority on the Board of Supervisors.

The era ended in 2010 when Ed Lee was appointed mayor, and he began ambitious agenda of pumping up a new dot-com bubble using tax breaks, public subsidies, and relentless official boosterism to lure more tech companies to San Francisco. Lee has been successful in his approach, in the process driving up commercial rents and housing prices. By some estimates, about 30 percent of the city’s economy is now driven by technology companies.

Yet there have been few voices in the local media raising questions about this risky, costly, and self-serving economic development strategy. The Bay Citizen did a story about Conway’s self interested advice, the New York Times did a front page story raising these issues, and San Francisco Magazine just last month did a long cover story questioning how much tech is enough. But most local media voices have been silent on the issue, and much of the damage has already been done.

 

OLD POWERBROKERS RETURN TO CITY HALL

More than a decade ago, then-Mayor Willie Brown and Chinatown power broker Rose Pak worked together to empower big business, corrupt local politics, and clear the path for rampant development — an approach that progressives on the Board of Supervisors repudiated and slowed from 2000-2010. But Brown, Pak, and a new generation of their allies have returned in power in City Hall, and it’s as bad as it ever was.

Many San Franciscans know of their high-profile role appointing Lee to office in early 2011. But their influence and tentacles have extended far beyond what we read in the papers and watch on television, starting in 2010 when their main political operatives David Ho and Enrique Pearce ran Jane Kim’s supervisorial campaign, beating Debra Walker, a veteran of the fights against Brown’s remaking of the city.

Now, this crew has the run of City Hall, meeting regularly with Mayor Lee and twisting the arms of supervisors on key votes. Pearce and Ho persuaded longtime progressive Christina Olague to co-chair the scandal-plagued Run Ed Run campaign last year, she was rewarded this year with Lee appointing her to the Board of Supervisors. Pearce has been her close adviser, and most of her campaign cash has been raised by Brown and Pak. Even progressive Sup. Eric Mar admits that Pak in raising money for him, a troubling sign of things to come.

 

THE REAL OCCUPY STORY

The Occupy San Francisco camp that was cleared by police last week may have been mostly homeless people. And major news media outlets from the start reported that Occupy was dangerous, filthy, and a civic eyesore.

But last fall, the camps were comprised of a huge variety of people that chose to live part or full time on the streets. Students, people with 9-5 jobs, people with service jobs, and the unemployed were all represented. Wealthy people who lived in the financial districts where camps popped up mixed with working-class people who came from suburbs and small towns. Families came out, welcomed in the “child spaces” set up in many Occupy camps throughout the country. Most camps also boasted libraries, free classes, kitchens, food distribution, and medical tents.

As news media focused on gross-out stories of pee on the streets and graphic descriptions of drunk occupiers, they managed to ignore the complex systems that were built in the camps. Nor did anyone mention that homeless people have the right to protest, too.

The Mirkarimi vote: Will there be some profiles of courage?

On Jan. 6, 2011, the Bay Citizen/New York Times broke a major investigative story headlined “Behind-the-Scenes Power Politics: The Making of Ed Lee.” The story by Gerry Shih detailed how then Mayor Gavin Newsom, ex-Mayor Willie Brown, and his longtime political ally Rose Pak orchestrated an “extraordinary political power play” to make Ed Lee the interim mayor to replace Newsom, the lieutenant governor-elect.

The story also outlined the start of a chain of events that leads to the vote by the San Francisco Board of Supervisors on Tuesday on whether Sheriff Ross Mirkarimi keeps his job.

Shih reported that “word had trickled out” that the supervisors had narrowed the list of interim candidates to three—then Sheriff Michael Hennessey, former Mayor Art Agnos, and Aaron Peskin, then chairman of the city’s Democratic party.  But the contenders “were deemed too liberal by Pak, Brown, and Newsom, who are more moderate.”

Over the next 48 hours, Pak, Brown, and the Newsom administration put together the play, “forging a consensus on the Board of Supervisors, outflanking the board’s progressive wing and persuading Lee to agree to become San Francisco’s first Asian-American mayor, even though he had told officials for months that he had no interest in the job,” Shih wrote.

The play was sold on the argument that Lee would be an “interim mayor” and that he would not run for mayor in the November election. The Guardian and others said at the time that the play most likely envisioned Lee saying, or lying, that he would not run for mayor and then, at the last minute, he would run and overpower the challengers as an incumbent with big downtown money behind him.  This is what happened. That is how Ed Lee, a longtime civil servant, became the mayor and that is how the Willie Brown/Rose Pak gang won the day for the PG&E/Chamber of Commerce/big developer bloc and thwarted the progressives.

Let us note that the other three interim candidates would most likely never have done what Lee did and suspend Mirkarimi for pleading guilty to misdemeanor false imprisonment in an arm-bruising incident with his wife Eliana. In fact, Hennessey supported Mirkarimi during the election and still does and says he is fit to do the job of sheriff. 

This was a political coup d’etat worthy of Abe Ruef, the City Hall fixer at the start of the century. “This was something incredibly orchestrated, and we got played,” Sup. John Avalos told Shih. Sup. Chris Daly was mad as hell and he voted for Rose Pak because, he told the Guardian, she was running everything in City Hall anyway. Significantly, the San Francisco Chronicle missed the story and ever after followed the line of its columnist/PG&E lobbyist Willie Brown and Pak by supporting Lee for mayor without much question or properly reporting the obvious power structure angles and plays.

This is the context for understanding a critical part of the ferocity of the opposition to Mirkarimi. As the city’s top elected progressive, he was a politician and force to be reckoned with. His inaugural address as sheriff  demonstrated his creative vision for the department and that he would ably continue the progressive tradition of Richard Hongisto and Hennessey. That annoyed the conservative law enforcement folks. He could be sheriff for a good long time, keep pushing progressive issues from a safe haven, and be in position to run for mayor when the time came. So he was a dangerous character.  

To take one major example, the  PG&E political establishment and others regard him as Public Enemy No. 1. Among other things, he managed as an unpaid volunteer two initiative campaigns during the Willie Brown era. They were aimed at kicking PG&E out of City Hall, enforcing the public power provisions of the federal Raker Act, and bringing  the city’s cheap Hetch Hetchy public power to its residents and businesses for the first time. (See Guardian stories since 1969 on the PG&E/Raker act scandal.)

He then took the public power issue into City Hall when he became a supervisor and aggressively led the charge for the community choice aggregation (cca) project.  His work was validated in the recent 8-3 supervisorial vote authorizing the city to start up a public power/clean energy program. This is the first real challenge ever to PG&E’s private power monopoly.

Significantly, Willie is now an unregistered $200,000 plus a year lobbyist for PG&E. He writes a column for the San Francisco Chronicle promoting, among other things, his undisclosed clients and allies and whacking Mirkarimi and the progressives and their issues on a regular basis.  And he is always out there, a phone call here, an elbow at a cocktail party there, to push his agenda.   The word is that he’s claiming he has the votes to fire Mirkarimi.

The point is that the same forces that put Lee into office as mayor are in large part the same forces behind what I call the political assassination of Mirkarimi.  And so, when the Mirkarimi incident emerged, there was an inexorable  march to assassination. Maximum resources and pressure from the police on Mirkarimi. And then maximum pressure from the District Attorney. And then maximum pressure from the judicial process (not even allowing  a change of venue for the case after the crucifixion media coverage.)  And then Lee calls Mirkarimi “a wife beater” and suspends him with cruel and unusual punishment: no pay for him, his family, his home, nor legal expenses for him or Eliana for the duration.

And then Lee pushes for maximum pressure from the City Attorney and the Ethics Commission to try Mirkarimi and force the crucial vote before the election to put maximum pressure on the supervisors. Obviously, the vote would be scheduled after the election if this were a fair and just process.

Lee, the man who was sold as consensus builder and unifier, has become a polarizer and punisher on behalf of the boys and girls  in the backroom.  

And so the supervisors are not just voting to fire the sheriff.  Mirkarimi, his wife Eliana, and son Theo, 3, have already paid a terrible price and, to their immense credit, have come back together as a family.

The supervisors got played last time and voted for a coup d’etat to make Lee the mayor, rout the progressives, and keep City Hall safe for Willie Brown and Rose Pak and friends.   This time the stakes are clear: the supervisors are now voting on the political assassination of the city’s top elected progressive and it’s once again aimed at helping keep City Hall safe for PG&E, the Chamber, and big developers.

The question is, will there be some profiles of courage this time around? b3

P.S.1  Julian Davis for District 5 supervisor: “Supes mum on sheriff,” read the Sunday Chronicle head. Nobody would say how he/she would vote. And poor Sup. Sean Elsbernd claimed that he would be “holed all Sunday in his office reading a table full of thick binders of official documents related to the case plus a few that he’s prepared for himself containing some case law.”  (Anybody wonder how he’s going to vote? Let’s have a show of hands.)  

The last time I saw Julian Davis he was holding a “Stand with Ross” sign at a Mirkarimi rally on the City Hall steps. With Davis, there would be no second guessing and hand wringing on how he would vote. That’s the problem now with so many neighborhood supervisors who go down to City Hall and vote with Willie and downtown. Davis would be a smart, dependable progressive vote in the city’s most progressive district (5), and a worthy successor to Matt Gonzalez and Ross Mirkarimi. If Davis were on the board now, I’m sure he would stand with Ross and speak for Ross, no ifs, ands, or buts. And his vote might be decisive.  

P.S. 2 The Chronicle’s  shameful crucifixion of Mirkarimi continues  The Chronicle has refused to run a timely and  newsworthy op ed piece from Evelyn Nieves, Mirkarimi’s former girl friend. She  wrote an op ed piece for the Chronicle four days before the Tuesday vote.  Nieves is an accomplished journalist who for several years was the San Francisco bureau chief for the New York Times.  She told me that she was notified Monday morning that the Chronicle didn’t have room for the op ed in Tuesday’s paper. I sent an email to John Diaz, Chronicle editorial page editor, and asked him why the Chronicle couldn’t run her op ed when the paper could run Willie Brown, the unregistered $200,000 plus PG&E lobbyist who takes regular whacks at Mirkarimi, as a regular featured column in its Sunday paper.  No answer at blogtime.

This morning, I opened up the Chronicle to find that the paper, instead of running the Nieves piece today or earlier,  ran an op ed titled “Vote to remove Mirkarmi,” from Kathy Black, executive director of the Casa de las Madres, the non profit group that advocates against domestic violence. It has been hammering Mirkarimi for months. On the page opposite, the Chron ran yet another lead editorial, urging the supervisors to “Take a Stand” and vote for removal because “San Francisco now needs its leaders to lead.” It was as if Willie was not only directing the Chronicle’s news operation but writing its editorials–and getting paid both by PG&E and the Chronicle.  And so the Chronicle started out with shameful crucifixion coverage of  Mirkarimi and then continued the shameful crucifixion coverage up until today. Read Nieves on Ross.

Well, the honor of the Chronicle was maintained by columnist Debra Saunders, virtually the Chroncle’s lone journalistic supporter of Mirkarmi during his ordeal. Many Chronicle staffers are privately supportive of Ross, embarrassed by Willie’s “journalism,” and critical of the way the Chronicle has covered Mirkarimi. Saunders posted the Nieves column her paper refused to print on her Chronicle blog. Damn good for you, Debra Saunders.  

 

 

Impertinent questions for the PG&E 3 supervisors

Note: The Guardian and I were delighted, after fighting PG&E since 1969 to enforce the public power mandates of the federal Raker Act,  to see the SF Board of Supervisors finally start the process rolling on a veto-proof 8-3 vote. Even the San Francisco Chronicle, after all these decades of opposition to public power, noted in its Monday story by John Cote:

“The move would effectively end Pacific Gas & Electric Co.’s decades-long monopoly on the consumer power market in San Francisco, and it would lay the groundwork for the city to generate its own power in the future.

“Public power has long been a goal of major contingent on the city’s political left.  The contract approval comes eight years after the city began setting up a community choice aggregation program, which allows municipalities to choose alternativve energy providers.”

 Two of the PG&E 3 are my supervisors–Sup. Sean Elsbernd and Carmen Chiu. (I live in West Portal in Elsbernd’s district and  a few blocks from Chiu’s Sunset district.) Sup. Mark Farrell was the third PG&E vote.  I  was curious how in 2012,  after PG&E’s misbehavior in the San Bruno blast and after its corporate shenanigans in San Francisco, after all the work that has been done by public power advocates and the  San Francsico Public Utilities Commission on CCA,  could Elsbernd, Chiu and Farrell  vote with PG&E and against public/clean/renewable power. I sent them emails asking some Impertinent Questions. Farrell and Chiu didn’t reply. Elsbernd to his credit did.  Here is the back and forth: .

As a constituent, I  am  curious why you voted last week  with PG&E and against clean energy and public power on the PG&E vote and didn’t say anything during the discussion.  I am also curious why, as a neighborhood supervisor, you seem to always vote with the Chamber of Commerce (l00 per cent, according to its last score card) and did so again  on this vote. On what major vote have you differed with the Chamber and PG&E?

I opposed the proposal because I have a real concern about the potential for a number of our neighbors becoming unwilling customers of this program.  I said nothing because I believe Supervisor Farrell and Chu expressed the point quite well.
Perhaps the biggest issue on which I differed from the Chamber was Proposition A in 2007, the MTA set aside sponsored by Supervisor Peskin.  I played a large role in supporting that measure, while the Chamber opposed it.

I am curious – on what issues has the Bay Guardian differed from SEIU 1021?

Feinstein screws Breed

Candidates in the District 5 supervisorial race, where one recent poll showed almost half of voters undecided about a field of imperfect candidates to represent the city’s most progressive district, have been sharpening their attacks on one another — and learning lessons about hardball politics.

Christina Olague, the incumbent appointed by Mayor Ed Lee earlier this year, has been taking flak in recent debates from competitors who are highlighting the schism between her progressive history and her more conservative recent votes and alliances. That gulf was what caused Matt Gonzalez to pull his endorsement of Olague this summer and give it to Julian Davis.

London Breed has now suffered a similar setback: US Senator Dianne Feinstein revoked her endorsement of Breed following colorful comments the candidate made to Fog City Journal, which were repeated in the San Francisco Chronicle, blasting her one-time patron Willie Brown.

Breed, whose politics have been to the right of the district, seemed to be trying to assert her independence and may he gone a bit overboard is proclaiming that she didn’t “give a fuck about Willie Brown.”

Sources say Brown has been in payback mode ever since, urging Feinstein and others to stop supporting Breed. Neither Brown nor Feinstein returned our calls, but Breed confirmed that she was told the senator was “concerned” about that published comment. And we know that Feinstein never called her to discuss the article, her comments or the fact that, perhaps at the behest of Brown, she was yanking her support.

On the record, Breed was contrite when we spoke with her and reluctant to say anything bad about Brown or Feinstein, except to offer us the vague, “There are a lot of people who respect and like me, and they don’t like what they see happening.”

I was in Zeitgeist on a Friday summer evening, at a planning meeting for the 20th anniversary of Critical Mass, when I first heard about the idea of kicking off the celebration week with a renegade bicycle ride over the Bay Bridge.

The people who first shook up the city’s commute two decades ago were going to take the idea of seizing space from cars a step further — and fulfill a longtime cyclist fantasy. They were going to take the bridge.

Chris Carlsson, the author/activist who helped found Critical Mass and has evangelized the concept around the world, reminded me of this super-secret ride last Wednesday when I finally got around to starting my reporting for this story. I was surprised that I’d forgotten about it — but yes, I told him, I still wanted to be there.

“This will galvanize our sense of the week,” Carlsson told me, explaining that Critical Mass has always been about “opening up a space for a conversation,” whether it’s about how urban space is used or who gets to make that decision.

“There is a real necessity to have a place for people to start thinking creatively. That’s Critical Mass’s enduring contribution, 20 years ago and today.”

What started in September 1992 with 48 cyclists pedaling together through San Francisco has become an enduring worldwide phenomenon. On the last Friday of every month, without leaders or direction, this group bike ride simply meanders through the streets, riders smiling and waving at motorists often perplexed at the temporary alteration of traffic laws by a crowd too big to stop or ignore. While views of Critical Mass may differ, the conversation about urban cycling that it started has had an undeniable impact on how people see cities and their power to shape them, placing it high on the list of San Francisco’s proudest cultural exports.

Last Friday evening — a week before thousands of people are expected to show up for the 20th anniversary ride Sept. 28 — I rode over to a meeting in the back of the art gallery at 518 Valencia, the welcome center for the week. The first international arrivals were there: four Europeans who flew to Mexico City, where most of them built tall bikes to cycle up to San Francisco for the anniversary ride, arriving last week after a four-month trek.

They were veterans of Critical Mass events all over Europe, which borrowed the concept from the Bay Area, and they were happy to be going back to its core.

Andrea Maccarone is a 31-year-old Italian who lives in Paris when he isn’t bike touring, which he does quite a bit, last year riding to consecutive Critical Mass events in Paris, Toulouse, Rome, and Madrid. “It began here and spread everywhere,” he said. “A lot of my lifestyle — I’ve been a bike messenger and worked in bike kitchens — is based on what started here.”

His French girlfriend, Marie Huijbregts, described a cultural happening that began when she was 8 years old. “It’s a political movement of cyclists to release the streets from the cars,” the 28-year-old told me. “It’s environmental, do-it-yourself, and a great way to meet people.”

She said she wanted to be here “because it’s supposed to be the biggest one and all the world was invited. It’s symbolic and I wanted to be a part of it.”

Carlsson has watched the event he helped popularize spread to hundreds of cities around the world, from the Biciletada in Sao Paulo to the Cyklojizda in Prague. He loves to see young people who have been energized by Critical Mass and the larger renegade cyclist movement that grew up around it — from DIY bicycle kitchens and art bikes to creative political actions that seize public spaces — “who dream of San Francisco with stars in their eyes.”

But he often feels like we’re the “hole in the donut” of this international urban cycling movement, unable to retain the same intention and energy that it had when Carlsson, Jim Swanson, and a group of their bike messenger and anarchist cyclist friends conceived of the idea (originally called Commute Clot) in the Market Street office of a zine called Processed World.

Carlsson still hears the stories from people whose lives were changed by Critical Mass. But it was only in the last year or so, as the 20th anniversary approached, that he started regularly riding Critical Mass again, with a new generation of participants often drawn by confrontational yahooism, riding well-trod routes and rejecting efforts to suggest destinations as counter to its leaderless ethos.

“It’s extremely predictable now and I’m sick of it,” Carlsson admitted to me, a less diplomatic version of what he wrote in the introduction to the newly released book of essays he edited, Shift Happens: Critical Mass at 20, writing that the “euphoria of cooperative, joyful reinhabitation of urban space is hard to sustain after a awhile.”

Yet that powerful central idea is still there, and it remains as relevant as ever in cities dominated by fast-moving cars. People working together to create “an organized coincidence” can still change the rules of the road, opening up all kinds of new possibilities.

“It is an unpredictable space and you never know what’s going to happen,” Carlsson told me. That’s true of the history of Critical Mass around the world — with its storied clashes with cops and motorists, and its glorious convergences and joyful infectiousness — and it was true of our quest to take the Bay Bridge the next day.

 

 

TO THE BRIDGE

We weren’t just being daredevils. The idea of fighting for a freeway lane against six lanes of fast-moving cars, drivers distracted by that epic view of San Francisco, was conceived by Carlsson as a political statement protesting current plans to rebuild the Bay Bridge with a bike lane going only from Oakland to Treasure Island, leaving out that final 2.5-mile stretch into The City.

And for years, the Bay Bridge had been out there as a symbol of where bikes couldn’t go — and in dozens of demonstrations, riders have sought to make it up those ramps, particularly during the Bikes Not Bombs rides protesting the US invasion of Iraq, only to be blocked by police.

Carlsson handed out flyers headlined “A Bay Bridge for Everyone,” harking back to the early pre-Internet “xerocracy” that used flyers to promote Critical Mass ideas or suggest routes. A local historian, Carlsson included photos and descriptions of the Bay Bridge with three lanes of cars in each direction on the top deck, back when the lower deck had trains.

Why couldn’t we have one lane back for bikes? Well, it’s actually under consideration — sort of.

The idea of creating a bicycle/pedestrian lane on the western span is the subject of an ongoing $1.6 million study by Caltrans and the Bay Area Toll Authority, which are looking at attaching paths to the sides of the bridge. That would likely require replacing the decks on the bridge with a lighter new surface to compensate for the added weight, all at a cost of up to $1 billion.

Carlsson thinks that’s ridiculous overkill, and probably intended to scuttle the idea (or else put the blame on bicyclists for the cost of resurfacing the bridge). “For five grand, in three hours it could be done,” he said, arguing that all cyclists need is a lane, a protective barrier, perhaps a lowering of the speed limit — oh, and the political will to recognize that we have as much right to this roadway as motorists.

“It is a sad commentary on the nature of our government that the only way the state transit agency will take bicycling seriously as everyday transportation is when pressured by demonstrations and organized public demands,” Carlsson wrote on the flyer. “Why don’t they take the lead in opening space for cycling instead of doing everything to obstruct, deny, and prevent cycling?”

Even getting to Treasure Island for a bike ride isn’t easy for the car-free. Muni only allows two bikes at a time on its 108 bus, so Carlsson borrowed a van to shuttle almost 20 of us out there in multiple trips. Among the crew were the group that rode up from Mexico City, a Peruvian, and many regular local Critical Mass riders, including Bike Cavalry founder Paul Jordan and LisaRuth Elliott, a 10-year Critical Mass rider who helped edit Shift Happens and coordinate volunteers for the anniversary week, along with a couple of its very early adherents: Hugh D’Andrade and Glenn Bachmann.

“Nobody knew what we were doing,” Bachmann said of that first ride. “We didn’t know what was going to happen. But displacing cars left us this intense euphoria.

Elliott said she was drawn to Critical Mass shortly after she got into urban cycling, attracted by the sense of community that had developed around her transportation choice. She was later inspired to visit Paris and Marseille and other cities that adopted Critical Mass rides.

“They have taken charge and are leading their movements to better bicyclable cities. It’s an adaptable idea,” she told me as we prepared to load our bikes on the van bound for Treasure Island.

Once we were out there, we gathered for a picnic on the beach in Cooper Cove, where we got some sobering news from David Wedding Dress, who talked us through the ride and was going to be trailing our crew in his Mercedes as a safety measure.

“Prepare to be in jail until Monday morning,” he told us. There were also the high winds and dangerous gaps to contend with, offering a bleak prognosis.

A veteran radical activist and bicyclist, Dress has ridden the bridge before and been arrested most times, and he didn’t share Carlsson’s view that we were most likely to get away with it. When Carlsson arrived, he tried to shore up our spirits, saying we’d probably be okay if we maintained the element of surprise.

“We have a right to do this and make that point,” Carlsson said.

Elliott, who was already a wobbler going in, decided not to ride, but 16 of us decided to do it anyway, feeling nervous but excited. When a CHP patrol pulled over a car near our spot and it turned into an hour-long arrest and towing ordeal, which we were forced to wait out, we had plenty of time to think about what we were doing.

As D’Andrade told me as we waited to ride up to the bridge entrance, “What feels to me like the early days of Critical Mass is how scary this is.”

 

THE EARLY DAYS

In the beginning, the Critical Mass activists say their battle for space was a safety issue infused with a political message, delivered with a smile derived from the joyous new discovery that riding with friends made it much easier. San Francisco streets were designed for automobiles, and to a lesser extent public transit, with cycling relegated to the bike messengers and a few renegades seen by most as simply refusing to grow up.

Even the nascent San Francisco Bicycle Coalition of that era — which grew in numbers and power on a similar trajectory as Critical Mass, despite its policy of maintaining a defensible distance from that outlaw event — was initially dominated by the philosophy that urban cyclists should ride quickly with car traffic and didn’t need separate lanes.

“That’s what I like to remind people is how scary bicycling was in San Francisco in the early ’90s,” D’Andrade said.

I first encountered Critical Mass in 2001 when I was the news editor for the Sacramento News & Review, and Berkeley resident Jason Meggs brought the movement into automobile-centric Sacramento. My reporters and I covered those early rides, which were met with a harsh crackdown by police, who often cited every minor traffic violation.

But Meggs was committed to the concept, as he wrote in his Shift Happens! essay entitled, “The Johnny Appleseed of Critical Mass,” a role he has played over the last 19 years. “Critical Mass made me a video activist and filmmaker; it sent me to jail and then to law school, and again to graduate school for healthy cities. It provided us the space to build a vibrant bicycle culture, and to feel free and alive in cities that otherwise felt hostile, caustic, and alien,” he wrote.

Meggs calculates that he’s been arrested more than 20 times and received more than 100 traffic tickets during Critical Mass events, beginning with the Berkeley Critical Mass that he started in March of 1993, in part to protest plans to widen I-80.

“Those early rides were legendary — moment to moment ecstatic joy and street theater,” he remembered. “The combination of bike activists and freeway fighters with anarcho-environmentalists on wheels was a combination that couldn’t be beat. Like a newscaster once said of Critical Mass, back then we were drunk with power.”

Yet in almost city where it’s sprouted, Critical Mass has had to battle through crackdowns by police, which are often met with greater determination by the cycling community. San Francisco fought through a showdown with Mayor Willie Brown in 1997, when his threats to shut Critical Mass down turned out thousands of cyclists for the next ride.

In 2007, the San Francisco Chronicle sensationalized a conflict between a motorist and Critical Mass, beginning a media campaign that led Mayor Gavin Newsom to order a heavy police presence on subsequent rides — a show of force, but one without any apparent plan or directive — again increasing number of cyclists.

Each time, San Francisco city officials were forced to accept the inevitability of Critical Mass, opting to avoid the route of the harsh, sustained, and costly crackdowns employed in New York City, whose police and city officials essentially went to war with Critical Mass in 2004 and have all-but destroyed it. Portland has also had a tumultuous relationship with its Critical Mass, with police there essentially shutting it down.

Yet Carlsson noted in his Shift Happens essay that the bicycle activism that formed along with those rides still prevailed: “Both cities — not coincidentally I think — have implemented extensive and intensive street-level redesigns to accommodate the enormous increase in daily cycling that followed the rapid growth and ultimate repression of their Critical Mass rides.”

San Francisco has seen an even greater explosion in the number of cyclists on the roadways, so many that spontaneous “mini-Masses” of cyclists form up during the daily commutes on Market Street and elsewhere. But despite the near-universal City Hall support for cycling here, and the SFBC’s status as one of the city’s largest grassroots political advocacy organizations, Carlsson said San Francisco’s cyclists still lack the infrastructure and policies needed to safely get around the city.

That’s one reason why the challenge of Critical Mass is still relevant, he said, and one reason why we were determined to ride our bikes into San Francisco on the Bay Bridge.

 

ANOTHER DAY

The cops left a little before 6pm, so we massed up and headed for the Bay Bridge, pedaling single-file up a long hill. Soon, the long western span of the bridge came into view, stretching to the downtown destination that we all hoped to reach without incident or arrest, as we passed a sign reading “Pedestrians and Bicycles Prohibited.”

As we crested the hill and dropped down toward the freeway entrance, our pathway seemed clear, with the only real variable being coordinating with Dress in the Mercedes trail car, but Carlsson was on the phone with him and we all assumed that we were about to ride our bikes onto the Bay Bridge.

We were in a fairly tight pack, Maccarone smiling atop the tall bike that had traveled so far to this point, as we rounded the swooping right turn to the point where even cars make a dangerously quick entrance onto the bridge from a complete stop, merging into loud and dense traffic moving at freeway speeds.

We stopped, looked back for Dress, and he wasn’t there. A minute crept by, then another, as cars drove cautiously past us to get onto the freeway, their drivers giving us the same quizzical, confused looks that we’d seen on Critical Mass so many times. Another minute passed, then another, as Carlsson lit one of the road flares that we planned to use as a secondary safety measure to the Mercedes.

Then, a CHP patrol car rounded the bend, the officer sternly telling us over his PA system, “Don’t even think you’re getting on this bridge with those bikes.”

So we turned around and began to head back when Dress finally arrived in his Mercedes, presenting a moment of truth. Did we proceed anyway, even though we had been warned and knew the officer had probably radioed in our presence, taking away the element of surprise and increasing our chances of arrest?

There was dissension in ranks and a clear division among those urging opposite courses of action, but Carlsson and others continued to ride away after talking the Dress, who proceeded onto the freeway. Later, Carlsson said he was still game to go at that moment, but tried to be responsive to the collective: “I was not comfortable imposing going on the bridge on everyone.”

D’Andrade advocated for going anyway, but most felt it was too risky at that point, siding with Carlsson’s argument that is wasn’t about getting arrested: “I like to do something and get away.”

And so it was decided that we would choose a strategic retreat, some pledging to take the bridge some other day, hopefully with greater numbers. Besides, we all had a big week ahead of us, starting the next day with the first official event of Critical Mass’s anniversary week: the Art Bike/Freak Bike Ride and BBQ.

We gathered the next afternoon on the waterfront under sunny blue skies, our aborted bike crew increased in size 10-fold, joined by underground DIY bike crews from San Francisco’s own Cyclecide to the Black Label crews from Minneapolis, Oakland, and Los Angeles, infusing the ride with a countercultural edge.

Urban bike culture is now vast and varied — from the eco-warriors and urban thinkers to wage slaves and renegade tinkerers — and they’ve all found a regular home in Critical Mass. “Twenty years on, people are kinda nostalgic about it, even if they don’t ride in it or think it’s a good idea,” an activist name rRez told me during that beautiful Sunday ride, the one we were able to take because we weren’t in jail.

Carlsson told me on the ride that he was at peace with our failed mission of the day before, a sign that being radical isn’t the same thing as being reckless. “That was a good strategic retreat moment. It’s very adult,” he said. “It was a good experience for all of us, and nothing bad happened and nobody is in jail.”

In a way, that’s the essence of Critical Mass. It isn’t pure anarchy, and it’s not about fighting with the cops or the motorists, something Carlsson sees as straying from its original intent. It’s a joyful gathering, an exercise in the power of people who are willing to challenge the status quo and take well-considered risks to create a society of their choosing.

“In a modern capitalist society, the roads are the lifeblood,” Carlsson said, “and if you block them, you’re a threat.”

Shortly thereafter, Breed said she got a call from Feinstein’s people withdrawing the endorsement. “There were just some concerns about the kind of language I used in the article,” Breed told us.

Sources say Brown has been in payback mode ever since, urging Feinstein and others to stop supporting Breed and switch to Olague. Neither Brown nor Feinstein returned our calls. On the record, Breed was contrite when we spoke with her and reluctant to say anything bad about Brown or Feinstein, except to offer us the vague, “There are a lot of people who respect and like me, and they don’t like what they see happening.”

Breed went after Olague hard during a Sept. 18 debate sponsored by the Haight-Ashbury Neighborhood Council and other groups, blasting Olague for her ties to Brown, Lee, and Chinatown power broker Rose Pak, claiming Olague is too beholden to that crew and D5 needs a more independent supervisor.

Asked to respond to the attack during the debate, Olague said, “I won’t dignify that with a response.” But it seems clear to anyone watching the race that Olague has been getting lots of support from Lee, Pak, and Brown and the political consultants who do their bidding, David Ho and Enrique Pearce, which is one reason many progressives have been withholding their support.

The Breed campaign this week trumpeted its endorsement by three prominent progressive activists: Debra Walker, Roma Guy, and Alix Rosenthal. But it has been Davis that has captured the endorsements of the most progressive individuals and organizations, including a big one this week: the Harvey Milk LGBT Democratic Club, which gave Davis is sole endorsement even though he’s straight and Olague is from the LGBT community.

Davis also snagged the number one endorsement of the San Francisco Tenants Union, a big one for D5, as well as the sole endorsements of Gonzalez, former Democratic Party Chair Aaron Peskin, and Sup. John Avalos. Assembly member Tom Ammiano also endorsed the Davis campaign, adding that to Ammiano’s earlier endorsement of John Rizzo, the other solid progressive in the race. Rizzo also got the Sierra Club and the number one ranking by San Francisco Tomorrow.

But Olague is enjoying quite a bit of union support, including snagging the sole endorsement of the San Francisco Labor Council, whose members in the trades like her controversial vote on the 8 Washington project more than progressives or her competitors, who all opposed the deal. Olague was also endorsed by the United Educators of San Francisco and California Nurses Association.

The biggest union of city workers, SEIU Local 1021, gave its unranked endorsements to Davis, Olague, and Rizzo, as did Sup. David Campos. Sup. Jane Kim – who has also occasionally parted ways with progressives after Ho and Pearce ran her campaign against Walker – gave Olague an early endorsement, but late this week also extended an endorsement to Davis.

“As someone who has championed rank-choice voting, it is important for me that progressives are thoughtful about how we strategize for victory.  I have known Julian Davis a long time, and I believe that he would be a strong leader that fights for progressive values that District 5 cares about, including sustainable streets and livable neighborhoods,” Kim said in a statement given to the Davis campaign.

Another important endorsement in D5 is that of the San Francisco Bicycle Coalition, which carried a faint whiff of controversy this year. The group gave Olague its number one endorsement and Davis its number two, but some SFBC members have secretly complained to us that the fix was in and that Davis actually got more votes from SFBC members, which most people thought was how its endorsements are decided.

SFBC Executive Director Leah Shahum told us she wouldn’t reveal who got the most member votes, but she did say that the SFBC Board of Directors actually decides the endorsements based on several factors. “The member vote is one of the factors the board took into consideration,” she said, listing a candidate’s record, relationship with SFBC, personal history, and other factors. “Nothing special was done in that vote, by any means.”

SFBC has been playing nice with Mayor Lee in the last couple years, despite his broken promise of getting the critical yet controversial Fell/Oak separated bike lanes approved by the SFMTA, which he first said would be done by the end of 2011, then by the end of 2012, but which lately seemed to be dragging into 2013.

At SFBC’s urging, Olague recently wrote a pair of letters to the SFMTA urging quicker action on the project, and it seems to have worked: Shahum said a vote on that project has now been scheduled for Oct. 16, and she’s hopeful that it might now be underway by the end of the year after all. As she said, “We’re thrilled.”

The historic PG&E/clean energy vote today

And so, after a Guardian campaign that started in 1969 to kick PG&E out of City Hall and bring the city’s own Hetch Hetchy public power to San Francisco residents and businesses, the San Francisco Chronicle reported  in Monday’s edition ( 9/17/2012)  that San Francisco “is on the threshold of taking a major step into the public power realm.”

The lead story by John Cote, under a big front page head “Clean power plan would skirt PG&E,”  nicely laid out the CleanPowerSF program and even said that the plan “would effectively break Pacific Gas and Electric Company’s decades-old monopoly on the consumer power market in its headquarters city.”

He quoted Sup. David Campos, sponsor of the legislation, as saying that “This is about giving consumers a choice. And for the choice to be meaningful, it can’t be dependent on one company deciding the energy future of this city.”  The plan goes before the board on Tuesday (9/18/2012) and public power advocates say they have the votes for passage, despite PG&E’s furious lobbying inside and outside City Hall.

What Cote didn’t say, and what the Chronicle has been blacking out for decades, is the crucial point that this clean energy/ public power plan is no ordinary vote on an ordinary issue.  It is an extraordinary vote that would  start the process to enforce the federal Raker Act of 1913 that mandates that San Francisco have a public power system because the city dammed Hetch Hetchy Valley in Yosemite National Park for its cheap public water and cheap public power.  The city got the cheap Hetch Hetchy water, but it never got the cheap Hetch Hetchy power because PG&E stole it and forced the city to buy PG&E’s expensive private power all these years. The cost: billions of dollars for decades to the taxpayers and enduring structural corruption at City Hall. The Guardian has called this PG&E/Raker Act scandal the biggest urban scandal in U.S. history. It still is.

It’s quite a story and I urge you to check out the hundreds of investigations, stories, editorials, cartoons, and graphics the Guardian has used for years to illuminate the scandal and fight to enforce  the Raker Ac t and bring our own Hetch Hetchy power to our own people in San Francisco.

Buried in the Cote story is a key political point: Mayor Ed Lee, the man who became interim mayor on a phony premise and then lied his way into a full term as mayor, reiterated his “concerns” through a spokesperson that he is, gosh, golly, gee, “concerned about the opt-out provisions, the risks associated with the contract and the cost to residents.”

Marvelous. Simply marvelous. Lee is once again enunciating the PG&E line that mayors before him, notably Willie Brown and Gavin Newsom, have used to keep City Hall safe for PG&E and undercut the threat of public power coming to San Francisco and disturbing PG&E’s questionably legal monopoly. Brown, let me emphasize, was under PG&E’s thumb before, during, and after his mayoral tenure and now operates as an unregistered, $200,000-a -year PG&E lobbyist, Chronicle columnist, and key Lee confidant  and ally.

The current public power proposal isn’t as strong as the three public power initiatives that PG&E spent tens of millions of dollars to defeat.  PG&E would still own the lines and network, handle maintenance, and send out the bills.

But the proposal would provide l00 per cent renewable power to residents who want to pay a bit more for it, build a customer base and revenue stream for city-owned renewable power generation, advance the city’s greenhouse-gas reduction goals, and set aside $2 million to study public power options.  Most important, it would be a helluva good first step toward enforcing the public power provisions of the Raker Act and kicking PG&E out of City Hall.

The supervisors and Lee should approve the legislation and move it forward vigorously and without delay.

This is a historic moment and a historic vote in San Francisco history.  The question is, who is going to be on the right side of history and who is going to be on the wrong side of history with a PG&E vote that will live in infamy?  B3

A tip of the clean energy hat to Ed Harrington, who successfully wrestled  the proposal through the sea of crocodiles and hippos at City Hall.  He delayed his retirement as general manager of the San Francisco Public Utilities Commission to finish up the proposal.  “This is the single biggest program that is even on the  horizon within the city and county of San Francisco to make any difference toward any of the goals that you have set as board members in terms of having a change in greenhouse gas emissions and climate change in San Francisco,” he told the supervisors’ budget committee last week as reported by Cote.  “This program can make a dramatic change.”  

And a tip of the clean energy hat to Sup. Campos, who put the proposal forward up against  fortress PG&E,  More: a tip of the clean energy hat and a  bow to all the many public power advocates who have fought for years to bring clean energy and public power out of the wilderness and to this position. Furthermore, I salute  Sheriff Ross Mirkarimi, who led the first  two public power initiative campaigns as the unpaid manager and then took on the herculean job of orchestrating the clean energy/cca proposal inside City Hall .when he became a supervisor. Mirkarimi is now paying the price for, among other things, successfully taking on PG&E and the PG&E establishment. His was an enormously courageous and important public service.  On guard,   B3

 

Obama’s appeal to SF’s divided Left draws mixed reactions

President Barack Obama has a divided political base, as local Democrats who showed up at the Laborers Local 261 hall last night to hear his nomination acceptance speech were immediately reminded by leftist protesters. And despite the belief by some true believers that his speech won over its target audience, I have my doubts.

Courage to Resist and its allies from Code Pink, the Occupy movement, and other groups targeted this Democratic County Central Committee watch party (and 24 others around the country) with an appeal that Obama free Bradley Manning, the US soldier accused of turning over classified documents to Wikileaks who has been kept in solitary confinement for almost two years without trial.

“President Obama needs to live up to his promise to protect whistleblowers,” said Jeff Paterson, founder of Courage to Resist and himself a Gulf War resister (and coincidentally the ex-boyfriend of newly elected DCCC member Kat Anderson). For more on that protest, read this.

DCCC member Hene Kelly (and a phalanx of SFPD cops) helped keep the entrance clear – something the good-natured protesters didn’t seem to threaten – and said she understood their perspective: “They’re here because they have a right to ask President Obama to free Bradley Manning, and I agree with them.”

But inside, DCCC Chair Mary Jung wasn’t so happy about this rain on their parade, telling the Guardian that she supported the ideas behind Occupy but said, “I think the message is misdirected at us,” ticking off Democratic Party positions on same sex marriage, immigration reform, and other issues.

When I told her that the protest was actually about Manning, whose fate is pretty clearly in the hands of Obama and his appointees, she offered this hopeful assessment: “I would hope it’s going to work it’s way through the courts as it’s supposed to. There is a process.”

When I tried to get District Attorney George Gascon’s take on whether that process comports with normal legal and civil rights standards, he told us, “I have no opinion. I need to digest the information a little more.” (That was more than Willie Brown offered, with the former mayor, unregistered political lobbyist, and San Francisco Chronicle columnist responding to my questions with, “I’m a columnist. I don’t make comments to other newspapers,” after he gave a speech to the gathered Democrats.)

But it didn’t take Gascon long to digest Obama’s speech, telling us afterward, “I think he hit it out of park. If this doesn’t get the enthusiasm up, nothing will.”

Yet my reaction, and most that I’ve heard since then from people who listened to the speech, wasn’t quite so enthusiastic. Yes, Obama had some good lines, and yes, he fairly effectively countered many of the Republican misrepresentations of his record and ability to quickly turn around the failing economy he inherited. And yes, I think the substance and messaging were more progressive than his centrist acceptance speech of four years ago.

“Times have changed and so have I,” Obama declared at one point.

But this is a party that still shares the same basic paradigm as the Republican Party, this story of American exceptionalism, protected by noble military “heroes” and guided by altruistic virtues, working within an economic system that can just keep growing and expanding the prosperity of US citizens indefinitely – the kind of rhetoric that still drove the crowd to a jingoistic chant of “USA, USA, USA!” at one point.

Yet it was a crowd where not a single person in the local hall applauded or cheered for this line by Obama: “Our country only works when we accept our obligation to each other and future generations.” He’s right, but he’s also been running the country in a way that robs from future generations in many realms (debt, infrastructure, global warming, energy, education, etc.) and doesn’t address our obligation to the protesters out front and the valid perspective that they represent.

“There are many shades of blue in the Democratic Party. We’re all blue,” Jung told me.

Perhaps that true, because I felt a little blue coming away from this event, but maybe not in the sense that Jung intended.

Toasting the titan

Special effects wizard Ray Harryhausen had to invent unconventional techniques to bring his movie magic to the big screen when he revolutionized the world of fantasy film making in the 1950s and 1960s. His work on Jason and the Argonauts (1963), Earth Vs. The Flying Saucers (1956), It Came From Beneath the Sea (1955), and The Beast From 20,000 Fathoms (1953), among many others, has influenced several generations of filmmakers that grew up watching his stop-motion creatures.

Harryhausen’s life and incredible career are celebrated in a new documentary, Ray Harryhausen: Special Effects Titan, an expansive look not only at the man and his work, but also the huge influence he continues to have in modern movie magic. Featuring interviews with Harryhausen (now 92), alongside Hollywood heavyweights like James Cameron and Steven Spielberg, the film is having its United States premiere Sat/8 at San Leandro’s Historic Bal Theatre thanks to Bay Area Film Events.

BAFE has put on a variety of great classic film screenings and parties over the past several years. “The main reason we got into doing these events is to have fun and present the films and subjects we love. Ray Harryhausen is a big part of that, our first show featured Ray’s work, so this brings us full circle,” says BAFE’s Bob Johnson.

While Harryhausen himself will not be in attendance, two local special-effects luminaries will be: Dennis Muren of Industrial Light and Magic and Phil Tippett of Tippett Studio. Both have publicly shared their admiration of the effects pioneer, and will discuss his influence on their work, which between them has included iconic imagery and characters from the original Star Wars trilogy, E.T.: The Extra-Terrestrial (1982), Jurassic Park (1993), Terminator 2: Judgment Day (1991), The Abyss (1989), RoboCop (1987), and many more.

“We would have loved to have Ray here as well, but unfortunately at 92, Ray is not traveling as he used to and feels that at this stage in his life, the documentary says everything he wants to say and he considers it the final word on his career,” says Johnson.

Documentary producer Tony Dalton, who put the film together with the cooperation of the Harryhausen family, will also be participating in the event via Skype from London.

“I spoke to Tony and he graciously agreed to be part of the show via Skype — and I say graciously because he will be doing this at about 3:30am his time in the UK,” says Johnson. “Since this is the U.S. premiere and the focus of the event is the documentary, we thought it was important that someone from the film be on hand to discuss how it came about, what it took to bring together many of Hollywood’s major producers, directors and special effects artists and just how everything came to be.”

The evening will also feature a screening of the classic Harryhausen film The Golden Voyage of Sinbad (1973), rare shorts, prizes, and more, all part of an event that will benefit the Ray and Diana Harryhausen Foundation.

“Ray has an immense collection of original props, materials, and film from the movies he worked on. This is amazingly rare in the motion picture industry where studios let props rot in storerooms or put them up for auction or just let them walk. It is even more rare for films the industry may not consider to be ‘A’ pictures,” says Johnson. “Ray and his wife Diana have set up a foundation whose main goals are to preserve, house and display these items, as well as make them available to share with the public. These funds are going direct to the foundation, so they will not be filtered through any other third party organization.”

“So, you can enjoy a celebration of Ray’s work, see a brand new documentary, relive Ray’s work with one of his films, meet two Academy Award-winning industry professionals, and be a part of preserving a part of motion picture history. Not too bad for a night out at the movies.”

John Stanley, who reported on the Bay Area entertainment scene for 33 years at the San Francisco Chronicle and spent five years hosting KTVU’s beloved late-night show Creature Features, has interviewed Harryhausen multiple times.

“On each occasion Harryhausen was like an enthusiastic youth, a child waiting in line outside a theater to see the latest Star Wars extravaganza. Ask him about the joy of creativity and he would sprinkle in the reality too — the long, difficult days of single-frame exposure that would stretch into weeks that would stretch into months,” says Stanley, who’s now an author.

“In the case of [1981’s] Clash of the Titans, it was going to be his last major stop-motion animation feature, as computerized special effects were just starting to take over the motion picture industry at that time. It was the end of an era for Harryhausen, but his enthusiasm for his specialized art carried through. Given the neverending life of film, as long as we continue to preserve it, Ray Harryhausen and stop-motion animation will live on forever; sweeping us into other dimensions and faraway worlds with its unique way of capturing the movements of what would have been mere figments of our imaginations without his devoted efforts to give them breathtaking life.”

The Ed Kennedy project: Journalists push for two posthumous Pulitzer prizes

    It is one of the great ironies of American journalism that Edward Kennedy, once vilified by colleagues, ejected from Europe by the U.S. Army and sacked by the AP for his exclusive report of Germany’s World War II surrender in defiance of  political censorship, is now the subject of two efforts to rectify a journalistic injustice by awarding him a Pulitzer Prize posthumously.

   One effort is a grassroots campaign launched from, of all places, Cedarville, CA in rural Modoc County by Ray A. March, editor of the Modoc Independent News monthly newspaper, to win a posthumous Pulitzer for hard news international reporting. March worked for Kennedy as a cub reporter at the Monterey Peninsula Herald half a century ago,

“After reading and reviewing ‘Ed Kennedy’s War: V-E Day, Censorship & The Associated Press,’ it was obvious to me that Kennedy had been denied a Pulitzer and it was time to correct an injustice,” March said, emphasizing that campaign supporters are professional reporters, editors, and photographers, and the campaign is catching fire. 

They include San Francisco Chronicle editor Ward Bushee, Pulitzer Prize winning photographers Kim Komenich and Sal Veder, San Francisco Bay Guardian editor at large Bruce B. Brugmann, former AP legal reporter Bob Egelko and Frank McCulloch, former managing editor of the Los Angeles Times, executive editor of the Sacramento Bee and chief Southeast Asia correspondent for Time, Inc.

    “Formal acknowledgment by the Pulitzer people of  Ed Kennedy’s courageous and enterprising news reporting is 67 years overdue,”  said campaign co-chair Eric Brazil, retired Los Angeles bureau chief for USA Today and a former reporter for the San Francisco Chronicle.

   The other effort is a move by Louisiana State University and retiring AP president and CEO Tom Curley to enter “Ed Kennedy’s War,’’ recently published by LSU Press, in the Pulitzer competition based on its literary qualities. 

The memoir has reposed, unpublished, in a filing cabinet since Kennedy’s death at age 58 in November, 1963, when he was struck by a car while a pedestrian in Monterey, where he was editor and associate publisher of the Monterey Peninsula Herald. 

    In a formal apology last May, Curley said that its repudiation of Kennedy “was a terrible day for the AP.  It was handled in the worst possible way… Kennedy did everything right.’’ 

   In a subsequent interview, he elaborated:  “Once the war is over, you can’t hold back information like that.  The world needed to know.’’ Curley has co-written the introduction to Kennedy’s memoir. 

       Kennedy was among 17 reporters from major western news outlets allowed to witness Germany’s formal surrender on May 7, 1945, on condition that they agreed not to break the news for 36 hours.   Unbeknownst to the reporters at the time, that suppression was the result of an agreement between U.S. President Harry Truman and British Prime Minister Winston Churchill to allow Russian Premier Joseph Stalin to hold a second surrender ceremony in Berlin.

    The embargo was broken shortly after Kennedy learned that news of the German surrender was being broadcast to Germany from a radio station in Flensburg, Germany.   He contacted military censors and said that since the cat was out of the bag and the security of Allied troops was no longer an issue, he intended to defy censorship and report the news, which he proceeded to do – using a military phone line — thereby registering the biggest news scoop of the entire war.

   Julia Kennedy Cochran, Ed Kennedy’s daughter, saved his unpublished memoir and pressed for its publication. She was the first to join March and Brazil in the campaign to see her father awarded a Pulitzer.

    When asked how she felt about a network of journalists supporting her father for a posthumous Pulitzer, she said she was surprised and honored.

    “It is astonishing that my father’s story still elicits so much interest among journalists. I am thrilled and honored that so many of them are signing on to the campaign for a posthumous Pulitzer for him,” she said in a recent interview.

In Richmond, is it safe to eat your garden fruits and veggies?

Questions remain about the safety of eating homegrown fruits and vegetables from gardens in Richmond and other areas affected by a fire at the Chevron refinery August 6.

The official line from Contra Costa County–where residents were told to shelter-in-place during Monday evening’s fire–is to wash the produce in your gardens extra well.

“It’s safe to eat your fruit and vegetables,” said Randy Sawyer, the county’s chief environmenta and hazardous materials officer. “We do recommend that you wash them in a weak soap solution like a dish soap.” If there was harmful residue on the plants, it would be visible, he said. “It wouldn’t be a dust product, it would be sooty.”

But local gardeners and environmentalists beg to differ, and many are anxious about the fire’s potential long-term effect on the area’s urban agriculture. At a tense community meeting on Tuesday night, gardeners from Urban Tilth rolled in wheelbarrows of wilted produce they said was destroyed by the refinery fire, which was contained after a few hours but burned into the night. 

“We have extreme concerns,” Urban Tilth executive director Doria Robinson told the Guardian. “We’re trying to work with soil and air quality scientists to figure out what we need to test and how we can test it to determine what is safe. In the meantime, we can’t stand by the food we have.”

Until we know what chemicals were burning in the fire and what remains in the air, it’s dangerous to assume our garden products are not contamminated, said Robinson, a Richmond resident herself. “If it’s particulate matter or dust, in theory you can wash it off. At the same time, you’re not exactly sure how certain chemicals react. More importantly, if you can wash the plant, what happens to the soil? Heavy metals like mercury are used in some processing. If that stuff was in the plume and it deposited in the soil” there could be lasting detrimental effects on our gardens, she said. 

When a Richmond resident at Tuesday’s community meeting asked what chemicals might be in the air, and Jeff McKay, Deputy Air Pollution Control Officer at Bay Area Air Quality Management District (BAAQMD), listed hydrogen sulfide, benzene, sulfur dioxide, and styrene. All four compounds are either considered poisonous, or suspected to be carcinogens. 

The BAAQMD’ lab analysis report tested for 23 compounds, including Benzene, but not the other three chemicals. Most of the chemicals “have been identified by the state of California as Toxic Air Contaminants,” according to the BAAQMD. And although the same report insists that the air pollution levels were “significantly below federal health standards,” the San Francisco Chronicle reported that 1,700 people ended up in the emergency room with respitory problems during or after the fire. 

Robinson said it is extremely difficult to trace health problems to individual pollutants. 

“The way that companies like Chevron have been able to pollute the air without liability is it’s extremely hard to trace back, and they can point to things like the highways,” she said. “This particular instance was so extreme that if we get a list of what was burning, we might be able to trace it back for the first time.”

Robinson and her team hope to have a plan to test Urban Filth’s produce by Monday, though she said financial barriers will make a comprehensive analysis difficult or impossible. Until the products are deemed safe, the organization is planning on suspending its school programs and refraining from eating from its 11 Richmond gardens, and Robinson urged residents to do the same with their personal plants.

“Before we take someone else’s word for it, we owe it to ourselves and our community” to ensure our food is clean, she said.

Trust the police?

On July 16, 2011, Kenneth Harding Jr. lay bleeding on the ground. He was surrounded by San Francisco Police officers, who were in turn surrounded by neighbors and community members. The minutes ticked by and no ambulance arrived. After 28 minutes, Harding was dead at 19. The official story: after being stopped in a Muni fare check, Harding ran from police, drew a gun, and shot himself.

A year later, family members and community supporters maintain that the official story is a lie. A protest on his death’s anniversary this week shut down Muni service for an hour in his honor.

But protesters weren’t speaking of just Harding. Since he was killed by law enforcement officers, so were Charles Hill, Alan Blueford, and Derrick Gaines. All have led to varying degrees of protest that feed tensions between the cops and segments of the community.

Hill’s fatal shooting by a BART cop in San Francisco sparked last summer’s OpBART demonstrations, the energy from which flowed into early manifestations of the Bay Area’s Occupy movement, which was also marked by tense standoffs with cops that were followed by “fuck the police” marches throughout the Bay Area.

Despite such lingering tensions, Mayor Ed Lee recently suggested curbing gun violence by giving cops stop-and-frisk authority, a controversial idea that has been the subject of massive protest movements in New York City where what critics say is widespread racial profiling heightens tensions between police and communities of color.

Lee’s idea was widely criticized, triggering the Board of Supervisors to pass a resolution on July 10 criticizing the idea, urging Lee to abandon it, and saying it would destroy trust between the community and police.

There has always been tension in San Francisco between police and segments of the community, but a series of emotional, high-profile episodes and unsatisfying official responses over the last year has frayed that relationship even more than normal.

 

HARDING’S CASE

When Harding was killed, his mother Denika Chatman moved from Seattle to San Francisco. She wanted to convict the officers she believes murdered him. But the SFPD announced within weeks of the shooting that Harding had shot himself.

Now, Chatman and attorney John Burris have filed a federal lawsuit. “I know that it was murder,” she said. “I know his human rights had been violated.”

Chatman and other family members and friends maintain that when Harding was stopped while off-boarding the T train by SFPD officers and asked for proof of paying the $2 fair, he was unarmed. Harding ran, and those officers drew guns and shot him.

Police say that Harding had pulled out a gun as he ran and shot at police, prompting their return fire. They didn’t recover a gun at the scene, but after a weeklong “community effort,” police say a neighbor turned in a gun found at the scene.

The gun shot .38 caliber bullets, police reported—smaller than the .40 caliber bullets in a standard-issue SFPD weapon. The police crime lab then concluded Harding’s fatal wound was from a .38 caliber bullet, a finding confirmed later by the Office of the Medical Examiner.

But as SFPD spokesperson Carlos Manfredi tells it, “The officers did not just stand around. Officers had just been involved in a violent confrontation, they were fearful for their lives…A hostile crowd began surrounding the officers.”

“It wasn’t until more officers arrived on scene to assist the primary officers and prevent them from being surrounded by a hostile crowd that could have potentially escalated the situation. Not to mention, the ambulance would not be able to enter a violent scene that could potentially put their lives at risk, until we feel it is safe,” he said. “Remember, the officers did not know if Harding was laying under the gun. Approaching an armed gunmen who was shooting at officers is extremely dangerous and life-threatening.”

But many say the police shouldn’t be afraid of the community it patrols. When Chatman moved to the Bay Area, she says, she found a community in Bayview-Hunters Point. She also found support in a movement against police violence, made up largely of grieving mothers.

When hundreds marched in San Francisco demanding that George Zimmerman be charged with murdering Trayvon Martin in Florida, Chatman joined other African American mothers in condemning police killings of their sons. Since Martin’s death, similar deaths have continued in the Bay Area.

Alan Blueford, 18, was killed May 6 in Oakland three weeks before he graduated high school. Derrrick Gaines was 15 when he was fatally shot June 5 in South San Francisco. Each case feeds anew the fears and resentments some communities feel toward the police.

 

POLICING THE COMMUNITY

Some Occupy reactions continued a tradition of a certain type of radical response to police: just get them out. For many, police are like foreign occupying forces in neighborhoods, afraid of locals they don’t understand and willing to shoot to kill in mildly threatening situations. Harding and Gaines were running away when they were shot; Blueford was allegedly wielding a screwdriver. In all these situations, shooting to wound likely would have sufficed for self-defense.

When asked how she would like to see police interact differently with Bayview-Hunters Point residents, Chatman didn’t see much potential. “Not at this point,” Chatman said. “There’s been too many murders. Things would have to change drastically. And the mayor trying to implement a stop and frisk? Kenny is a worst example of stop and frisk and racial profiling.”

Indeed, at the end of a tense year, Mayor Lee’s idea of adopting the stop-and-frisk tactics used in New York and Philadelphia has been met with intense dissent. Sup. Malia Cohen — whose District 10 includes Bayview-Hunters Point — and former Mayor Willie Brown, two of the mayor’s supporters, immediately came out against the idea.

“San Francisco should remain focused on community policing that values both law enforcement and building relationships with communities who live with gun violence. Anything less would undermine decades of hard work in building trust between local law enforcement and our neighborhoods,” she wrote in a San Francisco Chronicle op-ed.

Even the SFPD is wary of the idea.

“We are not passing stop and frisk,” Manfredi told the Guardian. “It’s not even an option on the table for the department. We’re using the same method we’ve been using this whole time: probable cause and reasonable suspicion.”

 

A TROUBLING PATTERN

The anniversary of Harding’s death comes a week after the Malcolm X Grassroots Movement released a highly circulated report that concluded an African American is killed by a police officer or someone “deputized to act in their name” every 40 hours.

“We call [the killings] ‘extrajudicial’,” the report notes, “because they happen without trial or any due process, against all international law and human rights conventions.” The report notes that only nine people have been charged in the 110 killings it looks at, and none convicted.

On paper, San Francisco isn’t having a particulary bad year. Manfredi said there have been “two officer-involved shootings and at least one was a fatality” so far in 2012. That’s compared to eight officer-involved shootings with three fatalities in 2011 and 14 officer-involved shootings with three fatalities in 2010.

But community perceptions and unease can linger for a long time when incidents don’t seem properly investigated or atoned for.

“It’s very alarming. Especially the rate that it’s happening at. And anybody is paying attention, they’re starting use all the same stories for all these young black teenage males that they’re murdering,” Chatman said.

Alan Blueford, 18, was killed by Oakland Police on May 6. He was confronted by police on suspicion of hiding a gun and ran away. Police first said he had drawn a gun and shot an officer as he ran; an investigation later revealed that the officer who was injured shot himself in the foot. There has been no evidence uncovered that Blueford had a gun.

A month later, Derrick Gaines, 15, was confronted by South San Francisco police, again for looking suspicious. Police say he ran away and drew a gun, and that they needed to fire in self-defense. At a community speak-out July 13, Gaines’ mother, Rachel Guido Red, said she had just received the coroner’s report. It’s conclusion? “Derrick was shot in the back.”

She related what she believes happened: “He was running. He was scared. He was tripped by the officer, and he didn’t have a chance to pick himself up because this man played judge, jury, and executioner.”

Over and over, police investigations clear the cops of wrongdoing, as an investigation of Hill’s shooting on a San Francisco BART platform recently did. Chatman said lawsuits like the one she filed are often the only way to seek justice.

 

DEMANDS FOR CHANGE

Chatman wants to see shoot-to-kill policies changed. “I would like to see a bill passed making these people responsible for murder,” she said. “And then maybe they’ll start going back to original ways, of maybe wounding somebody, firing a warning shot, or doing something to injure the person, instead of shooting to kill. Because now they all come with their guns drawn. How come every police man there has to shoot? Why do they all have to shoot? Why can’t one officer shoot, and just shoot to wound?”

Manfredi said the policy isn’t shoot-to-kill, but it isn’t shoot-to-wound either. Instead, it’s to aim for “center mass” (the torso area) and shoot until there is no longer a threat. “We never, ever had a shoot to kill policy,” he said. “We shoot to stop the threat. And once we assess the threat and realize there’s no longer a threat, then we stop.”

Sharen Hewitt, founder of the Community Leadership Academy and Emergency Response Project (CLAER) is also indignant about Harding’s murder. “I don’t think that I should pay for Kenneth Harding to be shot down in my streets because he didn’t have two dollars,” she said.

In her decade of work with CLAER, Hewitt has overseen many projects that improved conditions for families whose children were killed by police, from funding funerals for families who can’t pay to bury their dead to counseling for family members other than biological parents of murdered kids. CLAER also sends emergency responders to sites of murders.

“We thought it was important to deal with the immediacy of the homicide and provide support so we could mitigate the possibility of retaliation,” Hewitt said.

Hewitt also has ideas for how to increase trust in police. “They need to understand the nuances, so they see Johnny with the hoodie on and know, he’s a star quarterback. I’d like to see my cops, paid by my tax dollars, not going to Sonoma County to spend them. One day the officer might be out running and he’ll have a hood on, and he’ll understand the nuances of what people are going through,” Hewitt said. She also advocates for housing set-aside for police in every neighborhood, insuring that officers live in neighborhoods they patrol.

We asked Manfredi about this idea. “I’m a big proponent of having officers live in the community where they work, because then they can engage with the community,” he agreed. But, he said, “one of the major issues about San Francisco, the cost of living is extremely high. To buy a home out here, we’re talking in the millions of dollars. That’s just too expensive.”

He said that to make the idea work, the city would need to “implement some type of program or plan where they offer discounts for public officials so they can afford to live in the city.” He explained that even in less expensive areas like Bayview and Sunnydale, the cost of housing would be too high for police officers to raise a family.

The current entry-level salary for SFPD officers is $88,842 to $112,164. By comparison, the median household income in San Francisco is about $71,000. According to city-data.com, the median household income in Bayview is $47,147. In Sunnydale, Hewitt’s neighborhood, that figure is $33,641. “I would say, the police are part of the community,” Hewitt said. “And they must be held to community standards. What I’d like to do is make it part of common thought that they are perceived as community members.” She said the African American community has differing ideas on how to address police-related problem, but the tension is widely felt. “It’s not like the black community is monolithic,” she said, “although we are bearing the collective brunt.”

The malling of San Francisco

Shopping malls filled with national chain stores and restaurants are in many respects the antithesis of San Francisco. They’re the bane of any metropolis that strives to be unique and authentic. And those just happen to be qualities that make tourism this city’s number one industry.

The logic of modern capitalism, and its relentless growth into new markets, has already placed a Target or a Walmart, and a Nordstrom, Macy’s, Ross, or a JCPenney — along with a bevy of Starbucks, Applebee’s, Jamba Juice, and McDonald’s and myriad other formulaic corporate eateries — in just about every town in the country.

Do people really need them here, too? And in a city renowned worldwide for its scenic beauty and temperate (albeit sometimes foggy) climate, do people want to shop in the enclosed, climate-controlled malls popularized in the small or suburban towns that many residents came here to escape?

For me, the answer is no. Frankly, malls have an aura of artificiality that gives me the creeps — but I freely acknowledge that not everyone feels that way. Some San Franciscans may like malls and chain stores while others don’t.

But it doesn’t really matter what any of us think. Left unchecked, it’s the market that matters — and the logic of the market gives chain stores a huge competitive advantage over the mom-and-pops. Their labor and supply costs are lower, their financial resources are more extensive and appealing to commercial landlords, and their business models are based on constantly opening new stores.

All cities have to do is just say yes. And San Francisco has been increasingly saying yes to malls and chain stores.

The economic desperation that set in since the financial crash of 2008 has overcome the trend of resistance to so-called “formula retail establishments” that had been building in San Francisco during the years before the recession.

So now, rather than dying from neglect, the Metreon mall has been brought back to life by a huge Target store set to open this fall, the second Target (the other one at Masonic and Geary) going into a city that had once eschewed such national mega-retailers.

Just down the street, in the heart of the city’s transit-rich commercial center, the CityPlace mall that had been abandoned by its previous owners after winning city approval two years ago is now being built by new owners and set to open next spring with “value-based” national chain stores like JCPenney.

Projects funded with public money aren’t immune either. The new Transbay Terminal transit center now under construction will have its own mini-mall, with 225,000 square feet of retail, much of it expected to house national chains. Even more retail will be built on the ground floor of the dozen other nearby residential and office buildings connected to the project.

And it isn’t just these new malls going in a stone’s throw from the Westerfield Mall, Crocker Galleria, San Francisco Center, and other central city malls. All over town, national chains like the Whole Foods and Fresh & Easy grocery stores are replacing Cala Foods and other homegrown markets, or going into other commercial shells like the S&C Ford building on Market near the Castro.

Just a few years ago, the approval of Home Depot on Bayshore Boulevard (since then sold and opened as Lowe’s, another national chain) was a hugely controversial project approved by the Board of Supervisors on a closely watched 6-5 vote. Now, Lennar is building an entire suburban-style complex of big box stores on Candlestick Point, hundreds of thousands of square feet — without much controversy at all.

Even Walmart — the dreaded poster child for huge corporations that use their market power to drive down wages or force local stores out of business — is reported to be actively looking to open “a couple” of stores in San Francisco (see “Walmart sets sights on San Francisco,” June 24, San Francisco Chronicle).

To Livable City Executive Director Tom Radulovich and others who have long encouraged San Francisco to embrace the kind of urbanism advocated by famed author and activist Jane Jacobs — which emphasizes unique, neighborhood-based development that enhances public spaces and street life — accepting the malls feels like giving up on more dynamic urban models.

“It’s sort of an admission of failure,” Radulovich said. “It’s the failure of urbanism in San Francisco.”

 

 

MID-MARKET SYMBOLISM

Mid-Market Street is a bellwether for the type of city San Francisco may become. Every mayor since at least Dianne Feinstein in the late 1970s has called for the redevelopment of Mid-Market into a more active and inviting commercial and social corridor, and few have done so more fervently than Mayor Ed Lee.

Several city studies have explored a wide variety of ways to accomplish that goal, from eliminating automobiles and transforming Market Street into a lively pedestrian promenade to using redevelopment money, tax breaks, and/or flashy lighted signs to encourage distinctive development projects unique to San Francisco.

“But the city failed, so the market filled the void,” Radulovich said.

It isn’t that all shopping malls or enclosed commercial areas are necessarily bad, Radulovich said, citing the influential work by writer Walter Benjamin on the roles the enclosed “arcades” of Paris played in public life. “They work when they are an extension of public spaces,” Radulovich said.

Yet that isn’t what he sees being built in San Francisco, where what gets approved and who occupies those spaces is largely being dictated by private developers who are more interested in their bottom lines than with the creation of a vibrant urban environment where people are valued as more than mere consumers or workers.

San Francisco isn’t alone in allowing national chains to increasingly dominate commercial spaces. In fact, Stacy Mitchell, a researcher with the Institute for Local Self-Reliance, said that until recently San Francisco was one of the best big US cities in controlling the proliferation of chain stores.

But the city has lost ground since its anti-chain high water mark in 2007, when voters approved Proposition G, which expanded the controls on formula retail outlets — generally requiring them to get a conditional use permit and go through public hearings — that the Board of Supervisors had approved in 2004.

Those controls are only as good as the political will to reject a permit application, and that doesn’t happen very often. A memo prepared last July for the Planning Commission — entitled “Informational Presentation on the Status of Formula Retail Controls” — found that of the 31 formula retails applications the city received since 2007, just three were rejected by the commission, six were withdrawn, and 22 were approved.

It’s gotten even worse since then, as the two Targets and other chains have been courted and embraced by Mayor’s Lee’s administration, whose key representatives didn’t respond to Guardian interview requests by press time.

Mitchell said it’s not nearly as bad in San Francisco as it is in Chicago, New York City, New Orleans, and other iconic US cities whose commercial spaces have been flooded with chains since the recession began.

“It’s nothing compared to the no-holds-barred stuff going on in New York City right now,” Mitchell said. “Walking down Broadway now is like a repeating loop of the stores you just saw further up the street.”

It isn’t that these cities are actively courting the national chains in most cases. It’s just that in the absence of strong local controls, developers and large commercial landlords just prefer to deal with chains, for a variety of reasons.

“If you’re just going with the flow of what developers are doing,” she said, “you always end up with national chains.”

And that’s what San Francisco has started to do.

 

 

MALLS LIKE CHAINS

Stephen Cornell, the owner of Brownie’s Hardware and a board member of the nonprofit advocacy group Small Business California, said chains have a huge competitive advantage over local businesses even before either one opens their doors.

“In general, landlords tend to like chains more,” said Cornell, whose business has struggled against Lowe’s and other corporate competitors. “The landlord always worries: is this guy going to make it and do they have the funds to back it up?”

Big corporate chains have lawyers and accountants on staff, and professional systems established for everything from buying goods to opening new stores, whereas most local entrepreneurs are essentially figuring things out as they go along.

“They’re very good at selling themselves,” Cornell said. “They’re going to manipulate the system perfectly, whether it’s the city and its codes or dealing with neighborhood merchants.”

And for large malls, Cornell said the problem is even worse. Brokers that fill malls have standing relationships with the national chains — most of which are publicly traded corporations seeking to constantly expand and gain market share — and no incentive to seek out or take a chance on local entrepreneurs.

“Chains have a lot of advantages,” Cornell said.

Mitchell said there are two main ways in which malls favor national chains over local businesses. In addition to the relationship between mall brokers and national chains, malls are often built with financing from financial institutions that require certain repayment guarantees.

“What they want to see are credit-worthy clients signed onto those places, and that means national chains with a credit rating from Standard & Poors,” Mitchell said, noting how that “automatically locks out” most local businesses.

Cornell also noted that national chains have already figured out how to maximize their efficiency, which keeps their costs down even though that often comes in the form of fewer employees with lower pay — and less reliance on local suppliers, accountants, attorneys, and other professionals — which ends up hurting the local economy. In fact, big chains suck money out of the city and back to corporate headquarters.

“All those people are making money and spending money here, so you have to look at the full circle,” Cornell said.

Mitchell said there are often simple solutions to the problem. For example, she said that city officials in Austin, Texas recently required the developer of a large shopping mall to set aside a certain percentage of the units for locally owned businesses.

So rather than hiring a national broker to find tenants, the developer hired a local broker to contact successful independent businesses in the area who might be interested in expanding, and the project ended up greatly exceeding the city’s minimum requirements.

Mechanisms like that, or like the formula retail controls pioneered in San Francisco, give her some hope. But she said, “Whether the counter-trends will be enough to counter the dominant trend, I don’t know.”

 

 

PUBLIC SUBSIDIES

The increased malling of San Francisco isn’t simply the result of official neglect. Often, the city’s policies and resources are actively encouraging the influx of chain stores. A prime example is the massive redevelopment project on Hunters Point and Candlestick Point that city voters approved in 2008 after mega-developer Lennar and most San Francisco political officials pushed the project with a well-funded political campaign.

“If you’re selling the land to Lennar for a dollar, and then building all the automobile infrastructure for people to get there, then that’s a massive public subsidy,” Radulovich said of the big-box mall being built on what was city-owned land on Candlestick Point.

That public subsidy creates a cycle that makes San Francisco less intimate and livable. Creating commercial spaces on the city’s edge encourages more people to drive on congested regional roadways. These spaces are filled with national chain stores that have a direct negative impact on small, locally owned stores in neighborhood commercial districts all over the city, causing some of these businesses to fail, meaning local residents will need to travel further for the goods they once bought down the street.

“Those neighborhoods are going to be less walkable as a result,” Radulovich said, noting how the trend contradicts the lip service that just about every local politician gives to supporting local businesses in neighborhood corridors. “There’s a certain schizophrenia to San Francisco’s economic development strategy.”

Sup. Eric Mar has been working with Jobs with Justice San Francisco and other groups to tweak city policies that have allowed the chains to proliferate. Last year, Mar held high-profile hearings in City Hall on how national chains impact local businesses, which pointed to the need for additional protections (see “Battling big box,” Jan. 3).

This year, he’s working on rolling out a series of legislative initiatives designed to level the playing field between local interests and those of Wall Street and the national chains it champions.

Last month, the Board of Supervisors approved Mar’s legislation to add banks to the city’s formula retail controls, a reaction to Chase Bank and other national banks snapping up vacant stores in neighborhood commercial corridors such as Divisadero Street.

Now he’s working on legislation that would mandate minimum labor and community benefit standards for chain stores — including grocery outlets such as Fresh & Easy — and study how chains affect San Francisco’s overall economy.

“There should be good neighbor policies when they come into a neighborhood,” Mar said. “Some neighborhoods are so distressed they may want a big box grocery story coming in, but we need to try to mitigate its negative impacts.”

One of his partners in that effort is his brother, Gordon Mar of Jobs with Justice, who argues the city needs to have a clearer picture of how national chains impact local communities.

“We’ve definitely seen an increase in corporate chain stores coming into San Francisco in the last year, and nobody has really been tracking it,” he said.

While the Planning Department’s quarterly pipeline report shows that applications for retail outlets has held steady at about 3 million square feet on the way in recent years, it doesn’t break out how much of that is national chains — let alone how that impacts the city’s economy and small business sector.

The city’s Legislative Analyst is now studying the matter and scheduled to release a report later this summer, which Gordon Mar said will be helpful in countering the narrow “jobs” rhetoric that now dominates City Hall.

“They are exploiting the economic recession by saying they’re bringing much needed jobs into the city and serving low-income residents,” he said. “But when you bring out the facts about the impact of these low-road retail stores on neighborhoods and small businesses, there is a net loss of jobs and a lowering of labor standards.”

 

 

VALUING MALLS

Yet the fate of those controls is uncertain at best, particularly in a tough economic environment in which the city needs revenue, people are desperate for jobs, and many residents have seen their buying power stagnate, making the cheap goods offered by Target and Walmart more attractive.

“It’s complicated stuff,” Michael O’Connor, a local entrepreneur and former member of the Small Business Commission who favors formula retail controls, told us. “Stores like Target do appeal to lower income families…The progressive agenda needs to understand that working-class families need somewhere to shop.”

O’Connor acknowledges how small businesses like those he owns, including a clothing store, often can’t compete with national chains who buy cheap goods in bulk. So he said he favors protections in some neighborhoods while allowing chains in others, telling us, “I don’t have a problem with the Target going into the Metreon.”

That argument also held sway with city officials when they considered approving the CityPlace project two years ago, which was presented as a mall filled with “value-based” stores that would be affordable to median income San Franciscans.

“At the time, the decision was around whether a value-based retail operation made sense in that location, and the answer was an emphatic ‘yes,'” Barbary Coast Consulting founder Alex Clemens, who represented the project, told us.

On a national or global level, there are good arguments against reliance on national chains selling cheap imported goods, which has created a huge trade deficit between the US and countries such as China that costs American jobs — ironically, the very things that some use as arguments for approving chain stores.

“The recession has created a climate of desperation where cities are more easily swayed by the jobs argument,” Mitchell said, noting the falsity of those arguments by pointing to studies showing that the arrival of chain stores in cities usually creates a net loss in employment. Finally, supporters of chain stores say the cash-strapped city needs the property and sales tax revenue “Because they say they’ll produce a lot sales tax revenue, they’re going to get away with all kinds of shit,” Cornell said, arguing that shouldn’t justify city policies that favor big corporations, such as tax breaks and publicly financed infrastructure. “I certainly don’t think [city officials] should be giving them any advantages.” There are few simple solutions to the complex and interconnected problems that result from the malling of San Francisco and other cities. It’s really a question of balance — and the answer of whether San Francisco can regain its balance has yet to be answered. “Given the mayor’s approach to economic development, it’s inevitable that we’ll have more coming into the city,” Sup. Mar said. “But the ’50s car culture, and the model of malls that came in the ’60s, don’t build communities or strong neighborhoods.”

The 8 Washington embarrassment

I wasn’t shocked by the vote on 8 Washington. I knew it was happening; I knew we’d lost when the EIR went through. I knew we couldn’t count on a solid progressive bloc any more. I knew that the lobbying was intense.

But I have to say, at the end of the day I was embarrassed. Because the supervisors sold the city cheap.

In the earlier board discussions, Sup. Christina Olague and Sup. Eric Mar mentioned their concerns about the heigh and bulk of the project and said they would work with the developer, Simon Snellgrove, on changes. But the final project was exactly the same size.

Olague and Sup. Jane Kim were concerned about the amount of parking; the developer agreed to cut 50 spaces. But the actual size of the garage won’t be reduced at all; the only promise: There won’t be valet parking, so maybe not so many cars will fit.

Yes, Snellgrove agreed to set aside some scholarships for low-income kids to swim in the pool, which is a great thing and I fully support it. For a project that, according to available figures, will net the developer $200 million in profit — according to Sup. David Chiu’s analysis, a 72 percent rate of return — the scholarship money is peanuts.

There’s an additional 50 cent parking levy to pay for surface improvements in the area.

But as Chiu asked at the June 12 meeting, “Is the city getting an appropriate level of benefits based on Snellgrove’s profits?” Project foe Brad Paul — a veteran of more than 30 years of the city’s development wars — doesn’t think so. “They got nothing,” he told me.

Here’s how it went down:

Chiu started off by introducing the board’s budget analyis, Harvey Rose. Rose said he’d reviewed the finances of the project, and concluded that the city would get $50 million less out of the project than the developer or the Port of San Francisco, which owns some of the land and is a primary proponent, had originally claimed. Chiu also noted that not all the documents were in the file, but nobody else seemed to care.

In fact, through most of the discussion — limited discussion — and final votes, it was pretty clear that nobody was swayed by any of the facts that Chiu put forward. This deal was done long before the board members took their seats.

Chiu offered a series of amendments, none of them terribly radical. He pointed out that the deal requires the city to pay the developer $5 million for open-space improvements. “That’s an anomaly,” Chiu said, and moved that it be removed.

Kim, who throughout the meeting was the strongest supporter of the project, argued that the city often reimburses developers for open space. More, she said, compared to what the city has asked other major residential developers to give, this project is just dandy. “I would not say this is not a fair deal for the city,” she told her colleagues.

The vote on the $5 million giveaway? Developer 6, SF 5. Siding with Snellgrove: Christina Olague, Scott Wiener, Carmen Chu, Sean Elsbernd, Mark Farrell, and Jane Kim. Siding with Chiu and project opponents: John Avalos, David Campos, Malia Cohen, and Eric Mar. It’s an odd lineup — Cohen doesn’t always vote with the progressives, and I have to say it’s strange to see Kim and Olague siding with the four most conservative supervisors.

Chius’s second proposal: Since the city’s benefits were $50 million less than advertised, why not add $14 million to the affordable housing fee?
Developer: 7. Affordable housing: 4. Voting for the developer: Olague, Wiener, Chu, Elsbernd, Farrell, Kim and Mar.

Okay, one last try. Chiu suggested maybe just $2 million more for affordable housing. Wiener, as is he way, went off on his usual complaint that too much of the affordable housing money is for poor people and not enough for the middle class. The final vote:

Developer: 6. Affordable housing: 5. Voting for the developer: Olague, Wiener, Chu, Elsbernd, Farrell, Kim.

Kim, again, took the lead in promoting the deal on the final vote, saying that a parking lot and a private club were not a good use for the space and that “we are achieving here is a higher and better use for the land.” That’s what every developer talks about, by the way — higher and better use.

She also talked about One Rincon, that hideous tower next to the Bay Bridge that was approved after then-Sup. Chris Daly cut a deal with the developer that the San Francisco Chronicle denounced as a “shakedown.

Kim said that, considering the much-smaller size of the Snellgrove project, the benefits were richer than the Rincon deal.

I never liked the Rincon deal — that tower’s a disaster, an ugly scar on the skyline, and there was nowhere near enough affordable housing money. That’s because I think that the city should be building six affordable units for every four market-rate units, that there’s no need for more housing for the very rich and that our current housing policy is a disaster. (The Guardian wrote an editorial at the time that said it was good that Daly had gotten that much money, but was dubious about the whole project. In retrospect, we were too kind.)

I think all my readers at this point know that. So does Daly.

But I asked the former supervisor anyway to comment on the difference between 8 Washington and One Rincon. His thoughts:

1. The Rincon Hill agreement was negotiated by the district Supervisor working together with the communities most impacted by the development. 8 Washington was opposed by the district Supervisor and many nearby residents.
2. Most people in the South of Market were not diametrically opposed to highrise development in that location. The Planning Department had been working on a Rincon Hill neighborhood plan and was recommending upzoning for the area.
3. Rincon Hill had no waterfront trust issues.
4. The Rincon HIll development impact fee was $25 per square foot (over and above the required inclusionary affordable housing fee even though the Mayor’s Office contended that over $20 per square foot would kill the deal.) According to Kim’s release, her 8 Washington deal netted an additional $2 million for affordable housing and a $.50 parking surcharge. This even though development in Rincon Hill is not as valuable as the northern waterfront.

Folks: I think the city got taken to the cleaners here. I’ll stipulate that I’m against this project for much broader reasons. And maybe I’m just an old commie who thinks that the richer you are, the more you should give back, that the affordable housing fees on the most expensive condos in San Francisco should be higher than normal, that if Snellgrove nets $200 million, then the city by definition left too much on the table.

But I don’t think I’m alone in believing that if you’re going to approve something that will make a developer this rich, and let him use public land to do it, on the waterfront, you ought to get your fair share. And that didn’t happen.

Sutter’s CPMC deal isn’t healthy

At 10am on Friday, June 15, at the main chambers of the Board of Supervisors, the first of a series of public hearings will be held on specific aspects of the  development agreement governing the $1.9 billion Sutter Health/California Pacific Medical Center proposal to expand and centralize the giant health-care outfit’s health center by building a new 555 bed hospital at Geary and Van Ness. The deal involves demolishing the existing 220-bed hospital at St. Luke’s at Mission and Cesar Chavez and rebuilding a new 80-bed facility, expanding the Ralph K. Davies hospital at Duboce and Noe and closing down the old Children’s Hospital in Laurel Heights.

The hearing will be the first before the Board of Supervisors. Thus far, the project has been before only the executive branch: the Planning Commission and the mayor. After a brief introduction on the overall project the hearing will focus on the issue of jobs.

This is the largest project to be negotiated by the Lee administration — and although the mayor introduced it to the board in May, not one supervisor has yet joined him to sponsor the legislation. That’s an an odd situation given the importance of the project – and the fact that Mayor Lee can usually count on an automatic four votes from the conservative faction of the board. But not this time.

The hearing was requested by a coalition of more than 60 community, neighborhood, labor, and environmental organizations — San Franciscans for Healthcare, Housing, Jobs and Justice (SFHHJJ) — which has been closely following the project for the last two years.  Members of the coalition have already appealed the project’s environmental impact report, passed last month by the Planning Commission, and SFHHJJ has developed a series of amendments to the agreement that it has been pressing on the Board of Supervisors.  Board President David Chiu agreed to set a series of hearings on the project before it voted on, along with the determination of the appeal of the EIR, in  late July.  SGHHJJ hopes to use the hearings to get across the serious shortcoming of the agreement.  In addition, depending upon the appeal of the EIR,  a law suit may well be filed by some members of the Coalition.

In short, what starts next Friday is a big deal.

Not only is it a big deal in the development war that is at the heart of San Francisco politics, but it also is a big deal given what may well be done by the Supreme Court in deciding the constitutionality of all or part of the Affordable Health Care Act. If Obama’s health reform is struck down by the court, in all or in part, which seems almost certain, Sutter/CPMC’s plan will most definitely take on even more importance for the future of health care and its costs in San Francisco.

Sutter currently controls about a third of the market for health care in San Francisco.  With the construction of this project, it will control about 40 percent — a portion most knowledgable observers feel will give it market dominance  and an ability to actually set health care costs in San Francisco. Sutter’s business model — as shown in Berkeley when it took over Alta Bates and elsewhere in the state – demonstrates that  with a dominate market position, it jacks up prices.

As the San Francisco Chronicle noted in 2010: “…Sutter Health Co. has market power that commands prices 40 to 70 percent higher than its rivals per typical procedure — and pacts with insurers that keep those prices secret”.

A US Supreme Court that weakens or strikes down health care reform will simply re-establish the status-quo ante, a situation in which Sutter will thrive.

And that’s why the board’s conservative members are not supporting Mayor Lee’s deal: it simply does not protect the city — itself a major health care consumer for both its workforce and Healthy San Francisco — from Sutter’s history of turning market power into high health care charges.

SFHHJJ want the development agreement amended to place a cap on the costs charged to the city, allowing Sutter no more than 115 percent of the average charged  by  San Francisco’s other private, nonprofit hospitals.  It also wants Sutter/CPMC low charity care payments pegged at an average of what other nonprofit hospitals contribute, and it is calling for rebuilding St. Luke’s in San Francisco medically underserved south east to 180 beds, not the sure-to-fail size of 80 beds.

But there’s even more to deplore about the proposed deal.

In housing, although the EIR showed that a demand would be created for some 1,500 new two-bedroom homes, Sutter/CPMC agreed to only provide funds to build about 90 such homes. Such a massive shortfall will boost housing prices all other San Franciscans will pay.

The project’s impact on public transit at the Geary / Van Ness intersection will be large and ongoing. More than 20,000 new car trips will be generated at that intersection by the new hospital. Plans for a Bus Rapid Transit raised roadway for the 38 Geary — the most used bus line in the city — will have to be altered at an unknown price since the project calls for all auto traffic to enter the site on the Geary Avenue side.

Again, San Francisco taxpayers will be on the hook to pay for these new costs.

But it is the jobs aspect of the deal that is the most distressing. Sutter/CPMC has a long history of labor disputes with its workforce. Last year it replaced nurses who took a day off to protest their working conditions, and a replacement nurse hired by Sutter accidentally killed a patient. Sutter/CPMC refuses to agree to hire all of its 6,000 current employees for the new facilities. It’s requiring them all to apply as new workers, losing all of their seniority, with a real prospect that many currently employed San Francisco residents will lose their jobs once the new facility opens. All that Sutter/CPMC has agreed to do is hire 50 residents a year for four years – 200 new local jobs, total.

The  June 15 hearing will focus on the jobs issue and public comment is sure to be hot on this laughable “commitment” agreed to by the “jobs” administration.

Bike advocates have made real progress, but there’s still a long way to go

San Francisco Bicycle Coalition Executive Director Leah Shahum mused on how far this influential advocacy group has come during its 20th Annual Golden Wheels Awards last night, noting that the first such award recognized the commercial landlord at 555 Montgomery Street for installing indoor bike parking.

“Back then, that would get you a Golden Wheel Award,” she said, noting that this year’s award to the Building Owners and Managers Association of San Francisco (BOMA) was for its support of legislation requiring all commercial buildings in San Francisco to provide indoor bike parking. “We’ve come a long way in 20 years, clearly.”

In addition to the majority of the Board of Supervisors who showed up to offer their support, Shahum ticked off a long list of other city and regional officials who ride bikes and understand their potential as an increasingly important transportation option during the era of peak oil, traffic gridlock, and public health problems.

“Regularly, we have these top leaders in the city who are biking because they love it, biking because they’ve always biked,” Shahum said, citing the Sunday Streets road closures and the school district going from discouraging cycling to facilitating it as signs of the pro-bike mindset that has taken hold of San Francisco.

The fact that SFBC recognized BOMA – a powerful downtown player that has progressed from seeing cyclists as enemies to embracing them as allies – was telling of the mainstream embrace of bikes.

“We get it, we’re learning,” Meade Boutwell, president of BOMA’s board, told the crowd as he accepted the award, going on to say that “less cars are good for all of us.”

It was a lovely if ungrammatical sentiment and a sign of just how far the business community has come in accepting the imperative of promoting alternatives to the automobile. But there’s still a bit of a disconnect in San Francisco about the role that bikes play in the world’s great pro-cycling cities, evidenced partly by Boutwell’s opening comment, “Under this polyester suit is lycra.”

Keynote speaker Gil Peñalosa – executive director of 8-80 Cities, a nonprofit that promotes creation of cycling infrastructure that is safe and inviting from those 8-80-years-old – mocked the MAMILs (Middle-Aged Men In Lycra) and the notion that people should be athletic or wear special equipment to be able to cycle in cities.

“We dress normally, we act normal, and so on,” Peñalosa said, later arguing that, “Cycling is for everybody.”

In Boutwell’s defense, much of mainstream San Francisco still has a hard time accepting cycling as a normal, safe option. When the San Francisco Chronicle covered Pealosa’s visit to Sunday Streets last weekend – our version of the car-free ciclovias that Peñalosa pioneered as a city official in Bogota, Columbia more than a decade ago – reporter Sam Whiting was jarred by the guest’s casual approach.

“They had come from overseas and were riding in jeans and without helmets, both rookie mistakes,” he wrote of Peñalosa and his wife (“Sunday Streets welcomes its source of inspiration,” 6/4).

But Peñalosa argues that the real mistake is when cities cater primarily to automobiles at the expense of the safety and livability of their neighborhoods, and treat cycling as a dangerous fringe activity. He argues that cities should be built primarily around pedestrians, “but very close to the pedestrians is the cyclists…I think that cycling is just a more efficient way of walking.”

Public transit is important and should be robust, he said, but it’s just not as efficient, user-friendly, economical, or environmentally beneficial as bikes. “We need to walk and bike as a part of everyday life and then we’ll be much healthier,” he said.

Peñalosa urged the crowd to be politically active and push the city to prioritize bikes over automobiles, noting that even in wealthy neighborhoods, only about a third of residents drive cars. And from a design perspective, he said city officials must choose between “Streets for cars or streets for people.”

Once we make the latter choice, Peñalosa laid out an agenda for achieving that goal, starting with slowing vehicle speeds to no more than 20 mph in residential areas.

He cited statistics showing that only about 5 percent of pedestrians hit by cars driving 20 mph will die, whereas the fatality rate shoots up to 80 percent when the vehicles are traveling 40 mph. And for streets in which cars are traveling faster than 20 mph, he said it’s imperative to have bike lanes that are separated from cars by physical barriers, rather than just lines painted on the street.

He noted that Seville, Spain drastically increased its cycling rate in just a few years by committing to building bike infrastructure, and that Chicago Mayor Rahm Emanuel installed that city’s first physically separated bikeway within his first 30 days in office and has perhaps the US’s most ambitious program for installing new bikeways. “San Francisco should not be any less than Chicago,” he said.

In Cogenhagen, which already boasts some of the world’s highest rates of urban bicycle use, Peñalosa said the city has sought to capture more long-distance riders by building 200 miles of “cycle superhighways” – which includes two lanes in each direction to facilitate both fast and slow riders – all for the price it costs to build about a half-mile of subway.

The goal, he said, is to make cycling as “easy, fast, and convenient” as possible, and to apply the political pressure to make that a priority because “if you aren’t doing those things then someone else is and someone else is setting the agenda.”

Mayor Lee’s priorities are wrong

OPINION There was much back slapping at City Hall last week as officials congratulated themselves on what was described as a welcome “philosophical shift” in San Francisco politics.

The beneficiary of the acclaim and virtual political consensus was Mayor Ed Lee’s proposed budget, the largest in history — including an unexpected windfall of new revenue. The budget’s signature element, described in glowing terms by the San Francisco Chronicle’s C.W. Nevius and warranting its own special mayoral press conference, is the expansion of the police and fire budgets — an $82 million increase over two years.

Amid last week’s ovations was an unsettling silence from voices normally willing to cut through obscure numbers and rhetoric. Not one official commented that the best way to ensure public safety is to build strong children, families, and communities.

The cumulative impact of the devastating state budget and years of inadequate funding on families and children should not permit celebration. In light of millions in unanticipated revenue, politicians should not be satisfied with addressing urgent needs simply by sparing a few city departments from cuts, as appeared to be the case. Here’s what they should be thinking about:

• Our schools face the worst budget cuts ever, with SFUSD preparing to lay off 400 employees, reduce the already-too-short school year, increase class size, eliminate most school bus lines and all high school after-school programs, and under-fund everything from food to special education.

• Our childcare system is being gutted by the state, with $20 million in losses this year on top of $9 million from last year. This will impact thousands of families and result in the closure of centers and family childcare homes. Many fewer parents will be eligible for childcare subsidies (no one with two kids earning more than $37,500 a year will qualify) — pushing parents out of work and onto “welfare,” and children out of quality care and into unsafe settings.

• Support systems for children with disabilities are being eliminated and reduced through simultaneous cuts in multiple agencies.

• Young people entering community colleges or state universities face years of uncertainty — including whether their campuses will even exist. Already, the majority of SF students who enter City College are unable to graduate — stymied by costs, lack of educational support, or the inability to get classes they need.

It appears that little of the new millions will address these problems. The mayor’s budget does not even fully fund the voter-approved Public Education Enrichment Fund, passed in 2004 to provide essential services to public schools and preschools. Funding falls short by more than $10 million. Providing schools the funds to which they are legally entitled is the least we can do when the city lands millions in new resources.

Let’s be clear: crime is at historic lows — and has gotten that way with 200 fewer officers than the mayor is now advancing. There is little rationale to suddenly swell the ranks, at a cost of $140,000 per officer. The Fire Department’s inefficiencies have been well documented by city budget experts, and many cost-saving recommendations have yet to be implemented.

Before signing off on a budget they have not yet discussed in public (as it appeared to last week), the Board of Supervisors must evaluate fiscal options in full view. Private meetings with the mayor are no substitute for a robust debate now that the revenue facts are known. This is the city’s first two-year budget, and its policy direction will impact us all for years to come.

What looks to Nevius like a positive “drama-free, signature moment” for San Francisco, looks to many advocates for children and families like an abdication of responsibility.

Reduce, re-use, replace

Greg Gaar knows the names, characteristics, and birds and butterflies attracted by every plant in the native plant nursery that he tends. Last week, he proudly toured me through the garden, pointing out plants like Yarrow ("great for bees and butterflies") and the beautiful flowers of the Crimson Columbine, of which Gaar believes there are "only two others left in San Francisco."

Gaar has been working at 780 Frederick St., where he now tends the garden, for decades. His mother went to high school on the same block, the old site of Polytechnic High. Before Gaar became the gardener, he ran the recycling center that Haight Ashbury Neighborhood Council (HANC) operates next to the garden. Now, the pioneering green operation he helped build may shut down.

At the center, people can recycle their bottles, cans, paper products, and even used vegetable oil, and make some cash along the way. Those who use the center say it's a green and dignified way to make some money.

But residents in the surrounding area have complained for years that the center is loud and attracts homeless people. They also say that, due to their proximity to the recycling center, the chance that their trash will get rifled through at night is greater than in other parts of the city.

Citing these concerns, the center's landlord, the San Francisco Recreation and Parks Department (RPD), has spent the past few years trying to evict the HANC recycling center. The center got an eviction notice in December 2010. HANC's lawyer, Robert DeVries, successfully challenged the eviction. RPD sued for eviction again in June 2011, and that matter may finally come to a close June 6 when it will be heard by a three-judge panel in SF Superior Court.

DELIVERING THE GARDEN


RPD officials cite neighbor concerns, claims that the recycling center's services are outdated and obsolete, and the idea of planting a community garden in its place. In fact, the Planning Commission approved a community garden in the place of the recycling center last year.

Since then, HANC staff got to work building its own community garden. In just a year, they erected 50 beds from recycled wood, and according to Gaar, about 100 neighbors have plots that they currently tend.

As the recycling center's director, Ed Dunn, tells it, the infrastructure already in place at the recycling center made building the garden come naturally. HANC was able to fund it with income from the recycling operation, and plant it with seeds from the native plant nursery.

Dunn emphasizes that no city money was used to build the current community garden. The city had laid out a $250,000 budget for the garden after it was approved and designed in 2010.

A bundle of documents containing arguments against HANC, provided by RPD, includes details of the Golden Gate Park Master Plan, surveys indicating a great need for community gardens in San Francisco, and letters and statements from neighbors complaining about the recycling center.

A 2004 survey discussed in the documents found that community gardens are among the top "recreation facilities most important to respondent households." Community gardens came in fifth in importance, after walking and biking trails, pools, fitness facilities, and running and walking tracks. The documents include a detailed map of the "Golden Gate Park community garden preliminary plan," imagined at HANC's current site.

The map was drawn up in November 2010, the same month that a meeting of the Recreation and Parks Commission laid out the reasons that HANC had to go. Minutes from the meeting include the city's need for community gardens as well as some neighbors' disdain for the recycling center in that site. It argues that the needs of recyclers can be well met with other recycling centers in the city.

Seventeen other recycling centers operate in San Francisco. Most are located in neighborhoods on the city's edges, with a few in the Outer Sunset and Excelsior, although most are located in Bayview-Hunters Point.

But the commission doesn't seem concerned with potential nuisance to neighbors in directing more traffic to these other recycling centers, or with the difficulty poor recyclers have in getting out there. "The San Francisco Department of the Environment is confident that recyclers that use the facility will take their material to another existing site for proper handling," according to the meeting's minutes.

The commission is, however, concerned about a nuisance that the recycling center creates for Haight-Ashbury neighbors, according to the minutes. The notes cite "neighborhood noise, truck traffic, litter, and public safety concerns as negative impacts related to continuing operations at the site."

AGAINST THE POOR?


But is this really just another case of resentment against people who are poor and homeless?

HANC's Dunn argues that, in fact, much of the material that those who use the center bring in isn't taken from residential waste bins. Besides, it's not technically "HANC's CRV redemption program" that encourages recycling as a revenue source for the less fortunate. State law requires that consumers be able to redeem bottles and cans for cash.

The meeting minutes argue that the recycling center "enables illegal camping and illicit and unhealthy behavior in Golden Gate Parks' eastern end and in neighborhoods in close proximity to the site."

Supposed evidence for the position cites letters to the editor published in the San Francisco Chronicle, a frequent outlet for anger at the homeless. One concerned resident, Karen Growney, asserts that the center "provides no benefit to people living in Haight/Cole Valley."

HANC disputes this, saying that many neighbors use the center. They have beneficial relationships with many nearby businesses, including New Ganges restaurant just across the street. Its website, kezargardens.com, shows many smiling neighbors who use the center to recycle.

Notable among them is actor/activist Danny Glover, a Haight resident since 1957. In a video on the website, Glover — interviewed while in his car dropping off recycling at the center — says, "I would be dismayed and not happy if we close this wonderful recycling center down…It would be a tragedy, and a great loss to this city and this community."

In her letter, Growney also laments that her family "had to pay a considerable amount to build a wrought-iron, locked gate to keep people out of our trash." Another letter, written by neighborhood resident Curtis Lee, asks that the city "eliminate the Haight Ashbury Recycling Center," saying that, "It is a blight on the neighborhood and an attraction to rodents and homeless carts."

Of course, those carts come with people. HANC takes issue with the assertion that their services "enable" or "encourage" homelessness, as well as the assumption that the recycling center only serves the homeless.

Dunn says that many of the recycling center' clientele are elderly immigrants, often housed, who contribute to their family income with cash from recyclables. He also insists that "most of the people that use the recycling center don't camp in the park."

Homeless people certainly do use the center, but it's not clear whether its presence truly "enables illegal camping and illicit and unhealthy activity." Dunn finds it laughable to say that "the center creates homelessness." It's a lot of work to cart around recyclables all day, he says, and the dedicated recyclers are generally not the same people that ask tourists on Haight Street for spare change.

THE RECYCLERS


There is a great diversity in how homeless San Franciscans spend their days, and recycling is in many ways a specialized, committed way of life. In her 2010 ethnography of homeless San Franciscans, Hobos, Hustlers and Backsliders, Teresa Gowan focuses on the "recyclers," the segment of the homeless population who have made a habit of collecting bottles and cans as a way of getting by.

"The phenomenon that captured my interest was the steady stream of shopping carts loaded high with glass, cans, cardboard, and scrap metal rolling past my door," she wrote.

Some of her interview subjects show disdain for the recyclers, who work hard all day and don't get much cash out of it. Dealing drugs, stealing, or panhandling can be more lucrative and less backbreaking. One subject, a man named Del who, according to Gowan, mostly stayed in the Tenderloin, thought the "20, 25 bucks on a big load" that recyclers usually made was pathetic. "'And that's for heaving around a big old rattling buggy all day,' Del said pityingly. 'I can make 15 bucks inside'a two minutes.'"

But many of her interview subjects prefer to recycle anyway. Gowan describes another subject, Sam, as "a champion recycler, muscular and persistent, who often put in nine, ten hours on the trot." She quotes Sam saying, "Without this, I'd kill myself. Couple a days, I'd do myself in…. You get some guys, seems like they can deal with homelessness. I'm not one of them."

The book argues that "pro recyclers" included a "large core group who had created an intense web of meaning around their work as a kind of blue-collar trade."

PIONEERING HANC


Recycling for cash may not be a respected or taxed job "blue collar" job. But it's certainly green.

Since the center began operating in the 1970s, mainstream attitudes towards environmentalism and sustainability have shifted dramatically. The HANC recycling center was a product of the environmental movement, and helped usher in the widespread support for recycling.

Now, with curbside recycling fully functional in San Francisco, many call the recycling center's work obsolete. But HANC argues that the city needs all the help it can get if it is to reach its goal for zero waste in 2020. It also employs 10 people, and Dunn argues that it would be foolish of the city to eliminate those stable green jobs.

HANC has also helped move along the trend towards community gardens that RPD is now embracing so thoroughly that, ironically, it could lead to the recycling center's demise. HANC helped underwrite the Garden for the Environment project as well as the Victory Garden planted outside City Hall in 2008. Dunn says that the staff enjoyed the challenge of building the garden, and would be interested in helping the city by creating more gardens without city money.

Gaar says he's committed to continuing to work for a healthier planet, regardless of what happens to the center. He and the other HANC staff have come to see the eviction process as symbolic of a direction in which the city's heading, that also includes last year's Sit-Lie Ordinance: decisions designed to shuffle homeless people out of wealthy neighborhoods.
The arguments for the community garden, however, seem to indicate a strong desire for a greener city. It's not easy balancing environmental initiatives with NIMBY woes — especially when your backyard is Golden Gate Park.

The battle of 8 Washington

More than 100 people showed up May 15 to testify on a condominium development that involves only 134 units, but has become a symbol of the failure of San Francisco’s housing policy.

I didn’t count every single speaker, but it’s fair to say sentiment was about 2-1 against the 8 Washington project. Seniors, tenant advocates, and neighbors spoke of the excessive size and bulk of the complex, the precedent of upzoning the waterfront for the first time in half a century, the loss of the Golden Gateway Swim and Tennis Club — and, more important, the principle of using public land to build the most expensive condos in San Francisco history.

Ted Gullicksen, director of the San Francisco Tenants Union, calls it housing for the 1 percent, but it’s worse than that — it’s actually housing for the top half of the top half of the 1 percent, for the ultra-rich.

It is, even supervisors who voted in favor agreed, housing the city doesn’t need, catering to a population that doesn’t lack housing opportunities — and a project that puts the city even further out of compliance with its own affordable-housing goals.

And in the end, after more than seven hours of testimony, the board voted 8-3 in favor of the developer.

It was a defeat for progressive housing advocates and for Board President David Chiu — and it showed a schism on the board’s left flank that would have been unthinkable a few years ago. And it could also have significant implications for the fall supervisorial elections.

Sup. Jane Kim, usually an ally of Chiu, voted in favor of the project. Sup. Eric Mar, who almost always votes with the board’s left flank, supported it, too, as did Sup. Christina Olague, who is running for re-election in one of the city’s most progressive districts.

At the end of the night, only Sups. David Campos and John Avalos joined Chiu in attempting to derail 8 Washington.

The battle of 8 Washington isn’t over — the vote last week was to approve the environmental impact report and the conditional use permit, but the actual development agreement and rezoning of the site still requires board approval next month.

Both Mar and Olague said they were going to work with the developer to try to get the height and bulk of the 134-unit building reduced.

But a vote against the EIR or the CU would have killed the project, and the thumbs-up is a signal that opponents will have an upward struggle to change the minds of Olague, Kim, and Mar.

 

DEFINING VOTES

The 8 Washington project is one of a handful of defining votes that will happen over the next few months. The mayor’s proposal for a business tax reform that raises no new revenue, the budget, and the massive California Pacific Medical Center hospital project will force board members to take sides on controversial issues with heavy lobbying on both sides.

In fact, by some accounts, 8 Washington was a beneficiary of the much larger, more complicated — and frankly, more significant — CPMC development.

The building trades unions pushed furiously for 8 Washington, which isn’t surprising — the building trades tend to support almost anything that means jobs for their members and have often been in conflict with progressives over development. But the Hotel and Restaurant Employees Union joined the building trades and lined up the San Francisco Labor Council behind the deal.

And for progressive supervisors who are up for re-election and need union support — Olague and Mar, for example — defying the Labor Council on this one was tough. “Labor came out strong for this, and I respect that,” Olague told me. “That was a huge factor for me.”

She also said she’s not thrilled with the deal — “nobody’s jumping up and down. This was a hard one” — but she thinks she can get the developer to pay more fees, particularly for parking.

Kim isn’t facing re-election for another two years, and she told me her vote was all about the $11 million in affordable housing money that the developer will provide to the city. “I looked at the alternatives and I didn’t see anything that would provide any housing money at all,” she said. The money is enough to build perhaps 25 units of low- and moderate-income housing, and that’s a larger percentage than any other developer has offered, she said.

Which is true — although the available figures suggest that Simon Snellgrove, the lead project sponsor, could pay a lot more and still make a whopping profit. And the Council of Community Housing Organizations, which represents the city’s nonprofit affordable housing developers, didn’t support the deal and expressed serious reservations about it.

Several sources close to the lobbying effort told me that the message for the swing-vote supervisors was that labor wanted them to approve at least one of the two construction-job-creating developments. Opposing both CPMC and 8 Washington would have infuriated the unions, but by signing off on this one, the vulnerable supervisors might get a pass on turning down CMPC.

That’s an odd deal for labor, since CPMC is 10 times the size of 8 Washington and will involve far more jobs. But the nurses and operating engineers have been fighting with the health-care giant and there’s little chance that labor will close ranks behind the current hospital deal.

Labor excepted, the hearing was a classic of grassroots against astroturf. Some of the people who showed up and sat in the front row with pro-8 Washington stickers on later told us they had been paid $100 each to attend. Members of the San Francisco Planning and Urban Research Association, to which Snellgrove has donated substantial amounts of money in the past, showed up to promote the project.

 

BEHIND THE SCENES

But the real action was behind the scenes.

Among those pushing hard for the project were Chinese Chamber of Commerce consultant Rose Pak and community organizer David Ho.

Pak’s support comes after Snellgrove spent years courting the increasingly powerful Chinatown activist, who played a leading role in the effort that got Ed Lee into the Mayor’s Office. Snellgrove has traveled to China with her — and will no doubt be coughing up some money for Pak’s efforts to rebuild Chinese Hospital.

Ho was all over City Hall and was taking the point on the lobbying efforts. Right around midnight, when the final vote was approaching, he entered the board chamber and followed one of Kim’s aides, Matthias Mormino, to the rail where Mormino delivered some documents to the supervisor. Several people who observed the incident told us Ho appeared to be talking Kim in an animated fashion.

Kim told me she didn’t actually speak to Ho at that point, although she’d talked to him at other times about the project, and that “nothing he could have said would have changed anything I did at that point anyway.” Matier and Ross in the San Francisco Chronicle reported that Ho was heard outside afterward saying “don’t worry, she’s fine.”

Matier and Ross have twice mentioned that the project will benefit “Chinatown nonprofits,” but there’s nothing in any public development document to support that assertion.

Chiu told me that no Chinese community leaders called him to urge support for 8 Washington. The money that goes into the affordable housing fund could go to the Chinatown Community Development Corp., where Ho works, but it’s hardly automatic — that money will go into a city fund and can’t be earmarked for any neighborhood or organization.

CCDC director Norman Fong confirmed to me that CCDC wasn’t supporting the project. In fact, Cindy Wu, a CCDC staffer who serves on the city Planning Commission, voted against 8 Washington.

I couldn’t reach Ho to ask why he was working so hard on this deal. But one longtime political insider had a suggestion: “Sometimes it’s not about money, it’s about power. And if you want to have power, you need to win and prove you can win.”

Snellgrove will be sitting pretty if 8 Washington breaks ground. Since it’s a private deal (albeit in part on Port of San Francisco land) there’s no public record of how much money the developer stands to make. But Chiu pointed out during the meeting, and confirmed to me later by phone, that “there are only two data points we know.” One is that Snellgrow informed the Port that he expects to gross $470 million in revenue from selling the condos. The other is that construction costs are expected to come in at about $177 million. Even assuming $25 million in legal and other soft costs, that’s a huge profit margin.

And it suggests the he can well afford either to lower the heights — or, more important, to give the city a much sweeter benefits package. The affordable housing component could be tripled or quadrupled and Snellgrove’s development group would still realize far more return that even the most aggressive lenders demand.

Chiu said he’s disappointed but will continue working to improve the project. “While I was disappointed in the votes,” he said, “many of my colleagues expressed concerns about height, parking, and affordable housing fees that they can address in the upcoming project approvals.”

So what does this mean for the fall elections? It may not be a huge deal — the symbolism of 8 Washington is powerful, but if it’s built, it won’t, by itself, directly change the lives of people in Olague’s District 5 or Mar’s District 1. Certainly the vote on CPMC will have a larger, more lasting impact on the city. Labor’s support for Mar could be a huge factor, and his willingness to break with other progressives to give the building trades a favor could help him with money and organizing efforts. On the other hand, some of Olague’s opponents will use this to differentiate themselves from the incumbent. John Rizzo, who has been running in D5 for almost a year now, told me he strongly opposed 8 Washington. “It’s a clear-cut issue for me, the wrong project and a bad deal for the city.” London Breed, a challenger who is more conservative, told us: “I would not have supported this project,” she said, arguing that the zoning changes set a bad precedent for the waterfront. “There are so many reasons why it shouldn’t have happened,” she said. And while Mar is in a more centrist district, support from the left was critical in his last grassroots campaign. This won’t cost him votes against a more conservative opponent — but if it costs him enthusiasm, that could be just as bad.

President Obama’s bold endorsement of same-sex marriage should be only the first of his key acts in behalf of gay Americans. It’s now past time for him to redeem a 2008 campaign promise to issue an executive order barring federal contractors from discriminating against gay workers.

Such discrimination is already banned in Washington, D.C., and 21 states, including California. A presidential order would cover the millions of federal contractor employees in the other states. Building roads, bridges and dams are among the many essential tasks they perform throughout the country.

Previous executive orders, first issued seven decades ago, have made it illegal for contractors to discriminate on the basis of race or religion. Recent investigations by the San Francisco Chronicle and the gay publication Metro Weekly noted that Obama made his promise to add a ban on anti-gay discrimination during a meeting with a gay rights group in Houston four years ago.

The Chronicle quoted Heather Cronk, director of the gay rights group Get Equal, as noting that a non-discrimination order “would give concrete, real-life workplace protections to people who work for federal contractors like ExxonMobil that refuse, year after year, to add those protections on their own.”

Cronk recalled that former Bay Area activist Cleve Jones recently presented Obama with a binder containing more than 40 accounts of workplace discrimination in hopes of making a decisive case for a presidential order. The president accepted the binder, Cronk said, without saying a word. But later, Obama adviser Valerie Jarrett said the president had no immediate plans to ban contractor discrimination on his own.

That was confirmed a day later by Jay Carney, Obama’s press secretary. Carney claimed the president nevertheless “is committed to securing equal rights” for lesbian, gay, bisexual and transgender Americans. He cited Obama’s long-time support for the proposed Employment Non-Discrimination Act that would give federal protection to LGBT workers in government as well as private employment.

Instead of issuing an executive order, Carney added, the president’s plans are to take “a comprehensive approach” by pushing for passage of the non-discrimination act.

But, as the Chronicle noted, “the legislation has no chance of passing in the current Congress,” whereas congressional approval is not needed for an executive order to go into effect. In any case, there seems to be only a slight chance that Obama would suffer serious political harm for issuing an order, since polls show strong public support for him doing so.

The president has in fact been losing support because of his refusal to act. The Chronicle, for instance, noted the anger of Log Cabin Republicans, the gay rights group that led the legal fight against the “don’t ask, don’t tell” policy that had excluded gays and lesbians from military service. The GOP group complained that Obama has “turned his back on 1.8 million LGBT workers” and failed to deliver on a policy that has broad, bipartisan support among the American peopl

Harsh criticism came, too, from a former congressional staffer, Tico Almeida, who helped draft the Employment Non-Discrimination Act and now heads a group called Freedom to Work. He called Obama’s refusal to act “a political calculation that cannot stand” as he announced that his organization was launching a campaign to increase pressure on Obama to issue an order.

One prominent – and wealthy – activist who’s pledged to contribute $100,000 to the drive to get Obama to change his mind called his refusal to sign an order “craven election-year politics.”

Pretty strong language, but Obama’s inaction on such a vital issue rightly opens him to such harsh judgment. His endorsement of same-sex marriage took genuine political courage. It proved he has the strength, the will and the ability to take the country another step closer to granting true equality to all Americans. Now the president needs to take that next essential step.

Sonic attack on the poor

It was 11pm on Thursday, May 3, and the ballet was just letting out. Affluently dressed dance enthusiasts streamed arm in arm down Grove street towards the Civic Center BART station chatting about the evening performance. That night’s show of Don Quixote at War Memorial and Performing Arts Center was likely excellent judging by the theatergoers’ exuberance.

As they passed by the Bill Graham Civic Auditorium, a half-dozen homeless people seated along the route begged the procession for change. Across the street and a block down Grove, a few homeless individuals had bedded down for the night in front of the Main Library.

It is these encounters, normal to urban life, that are at the center of a controversial strategy by Another Planet Entertainment, which leases the auditorium from the city, to drive the homeless away. They hope that by blasting a late night sampling of industrial noise through the venue’s sound system between the hours of 11pm and 7am, making sleep nearly impossible, that the homeless will be discouraged from congregating there.

A women selling the Street Sheet newspaper on the corner sums up the social tension that invoked the strategy. “They’re doing it to keep the homeless from sleeping there. All these people don’t want to see the homeless when they come through here,” she said, gesturing to the now thin stream from the ballet.

She had heard the noise over the past few nights and described it as deafening. “The first time I heard it I thought the building was under construction, then I thought a motorcycle gang was coming through. It is so bad it makes the windows of the building shake.”

Another Planet had no comment on the racket and would not say if the strategy would continue. But in an interview with the San Francisco Chronicle, company founder Gregg Perloff said the venue has had “an enormous amount of complaints” from their patrons about the homeless.

Late at night, police are powerless to respond to such complaints. The city’s carefully crafted sit-lie ordinance, which bars people from assuming either of those postures on city sidewalks during the day, is lifted between the hours of 11pm and 7am to satisfy constitutional concerns that have overturned similar ordinances in other cities.

“This it the first time I’ve heard of a strategy like this used against the homeless,” Bob Offer-Westort, civil rights organizer with the Coalition on Homelessness, said of the noise. “It is really problematic for a business to say that people on public property not breaking the law are a public nuance. It is a intrusion of a private company on public space.”

Standing in front of the building late on a foggy night, it’s easy to see why the homeless would gravitate to here. The building’s huge awning, covering much of the broad sidewalk, must be the easiest place to stay dry outdoors for many blocks. And since the demolition of the city’s old central bus terminal last year, it is perhaps the largest dry public space in the city’s core.

But is this sonic attack even legal? That’s a question that the Mayor’s Office and the San Francisco Police Department, neither of which answered our repeated inquiries, don’t seem to want to address.

San Francisco’s noise ordinance is a weighty document. Most cities suffice with a paragraph or two to regulate noise, while San Francisco’s ordinance runs nine pages. Noise, or rather the relative lack of it, seems of great importance to the city. There is even a city committee on noise.

The reason for the seriousness the city gives the issue of controlling excess noise is expressed in the very first paragraph of the noise ordinance: “Persistent exposure to elevated levels of community noise is responsible for public health problems including, but not limited to: compromised speech, persistent annoyance, sleep disturbance, physiological and psychological stress, heart disease, high blood pressure, colitis, ulcers, depression, and feelings of helplessness.”

Many of the cities homeless already suffer acutely from conditions on this list. Asked how an already vulnerable population could be affected by random industrial noise known to (and in this case intended to) cause agitation, Offer-Westort said, “It’s crazy to try to create these conditions, they are quite literally trying to create a civil disturbance, and not on their own property, but in a public space.”

With the adverse effects of noise pollution well-outlined, the ordinance goes on to state, “In order to protect public health, it is hereby declared to be the policy of San Francisco to prohibit unwanted, excessive, and avoidable noise.”

The ordinance pays particularly attention to licensed entertainment venues like the Bill Graham auditorium: “No noise or music associated with a licensed Place of Entertainment shall exceed the low frequency ambient noise level defined in Section 2901(f) by more than 8 dBC.”

As a matter of comparison the difference between a whisper and a quiet conversation is roughly an eight decibel increase, a relatively narrow margin. It seems reasonable that if you’re standing outside a venue, and the music coming from inside sounds louder than the person talking next to you, the city’s noise ordinance has been exceeded.

So motorcycles, saws, and other industrial sounds that were described at the auditorium late at night would range around 100 decibels without being amplified. Amplify it enough to shake the window in the building, one can assume it’s louder than a power tool, louder by far than the noise ordinance permits.

Everyone who has ever held a loud late night event in the city know the consequences of breaking the noise ordinance. A knock on the door by the SFPD that comes with a ticket and the end of your gathering. Do it again in a year and the fines doubles.

The strategy at the auditorium seems to be having some effect, but where the homeless will be shuffled off to is anybody’s guess. The reality of the homelessness crisis is there is no place for the homeless to simply move off too. With their numbers in the thousands, only bold political action on behalf of the city’s leadership can solve the problem.

“The root of the problem is that people can’t afford rent. Everyone who rents in San Francisco knows that it is way too expensive to live in this city,” says Offer-Westort. “We stopped creating public housing. Housing has become a commodity, an investment rather then a home, and that has driven up prices.”

Passing back through the area later at night, the building was quiet for the moment. A tow truck was loading a car out front with a beeping alarm, a motorcycle roars by, a boombox is playing across Civic Center Plaza, a man is yelling around the corner only to be drown out by a broken wheeled shopping cart clanking by. If this is the normal late night quiet of the streets, it’s a wonder the homeless get a moments sleep at all. But the building itself remains quiet right now.

A lone homeless man has bedded down in front but has not yet fallen asleep. Young and dreadlocked, he tells me that he has been in town only two days and is unaware of the controversial blasts of noise.

“God I hope they don’t do that,” he said from his sleeping bag. “It’s supposed to rain tonight. Why would they do that? As long as you are up before sunrise and move on, who are you bothering?”

And here in front of the auditorium in the middle of the night, with the concert patrons at home getting a comfortable night’s sleep, the question seemed valid. “It’s mean spirited. I think that we as society agree noise should be maintained at a reasonable level to not bother your neighbors,” said Offer-Westort. “The fact that their neighbors are homeless doesn’t mean they are not part of society.”

What does it mean that a historic preservation law favored by developers and promoted by Sup. Scott Wiener passed the Board of Supervisors 8-3? Maybe nothing. Historic preservation is a strange poliltical issue, favored by some of the wealthy white homeowner types who love pretty buildings (and aren’t so good on other issues), and this thing was sold as a way to help low-income people and affordable housing. But the reality is that the Wiener measure will make it harder to declare historic districts, and thus will take away a tool that the left can use to stop uncontrolled commercial development. And remember: The affordable housing community wasn’t pushing this bill, and, for the most part, hasn’t had problems with historic preservation. The most progressive political club in the city, the Harvey Milk LGBT Democratic Club, came out strongly against the measure and urged Sup. Christina Olague, a co-sponsor, to oppose it:

We are extremely troubled that you appear to be buying into the flawed, bogus and self-serving arguments by SPUR and other supporters of this legislation that historic preservation is classist and leads to gentrification, interferes with the production of affordable housing and is a tool of San Francisco’s elite.  Nothing could be further from the truth.

There was a way to address the issues of low-income people in historic districts without making it harder to block inappropropriate development, but Wiener’s bill went much further. And while I respect Scott Wiener and find him accessible and straightforward, and I agree with him on some issues, he isn’t someone whose basic agenda promotes the interests of tenants or low-income people. His supporters are much more among the landlord class and the downtown folks. The San Francisco Chronicle, which is a conservative paper on economic and development issues, loved the legislation.

So what happened when this got to the Board? Only three people — the ones the Chron calls “the stalwart left flank of the Board” — voted no.

John Avalos, David Campos and Eric Mar. They are now the solid left flank, the ones who can be counted on to do the right thing on almost every issue. Once upon a time, there were six solid left votes. Now there are three.

What does this mean for the other key issues coming up, including CPMC, 8 Washington, and the city budget? Maybe nothing. As I say, this issue is complicated. Olague told me, for example, that she’s really worried about working-class people who can’t afford to comply with the increased regulations that come with historic districts. Her vote doesn’t mean she’s dropped out of the progressive camp, or that she (or Sups. Jane Kim and David Chiu) can’t be counted on in the future. I really want to believe that this was just an aberration, a vote where I’ll look back in the fall and say: Okay, we disagreed on that one, but nobody’s perfect

Still, it’s kind of depressing: The dependable progressive vote is down to three.
