Occupy brings the noise to the Canadian consulate for Quebec students

Activists with Occupy San Francisco, Occupy Education Northern California and other groups staged a small demonstration outside the building that houses the Canadian consulate to express solidarity with student strikes in Quebec.

Protesters brought pots and pans to the building at 580 California, banging them in tribute to the casserole marches that have characterized the Quebec strikes.

Students in Quebec province have been on strike since February. School has let out for the summer, but the uprising shows no sign of stopping- in a massive demonstration June 22, some reports showed 100,000 marching in the streets of Montreal, and recently teachers have pledged to join students. 

“Last Friday, they had 100,000 people in the streets,” cried Stephan Georgiou, a former CCSF and UC Berkeley student. “The students of Quebec have continued to take to the streets despite Bill 78.”

Bill 78, passed as an emergency measure May 18 by the National Assembly of Quebec, forbids protests on or near school grounds, requires that march organizers submit their route to police in advance of demonstrations, and attempts insure that all classes resume in late summer.

Security guards allowed two protesters into the building and representatives from the consulate came to the lobby to receive a list of demands written by the group, which included the release and dismissal of charges against imprisoned students, the repeal of Bill 78, and “the end of all austerity measures for students, because education is a human right.”

Protests in Quebec began over proposed tuition hikes, and at yesterday’s rally, students from area high school and colleges told stories of their student loan debt during the rally.

“I was a senior in high school in the 2011/2012 school year. I applied to SF State,” said Hannah Stutz, 17. “My parents are currently in debt, so I needed to apply for financial aid.”

With a loan offered by FAFSA, Stutz said, “I was awarded $70 if I take out a $30,000 loan.”

“I’m a single father, I have yet to graduate college, and I’m $60,000 in debt,” said another protester.

Last March, US total student loan debt surpassed $1 trillion.

“It’s approaching the amount of the bank bail outs,” said one protester. “They should have just bailed out all the student debt. The money would have gone to the banks anyway.”

Indeed, activists and polticians have thrown around the idea of widespread student loan debt forgiveness, as well as a debt strike– simply refusing to pay.

“The average debt people graduate with is now $25,000,” said Beezer de Martelly, a graduate student at UC Berkeley, “and we all know how quickly these prices are escalating.”

“On November 9, we were beaten in exchange for trying to keep dept down for future generations,” she said, recalling Occupy Cal protests against tuition hikes during which students were notoriously beaten by police.

“There is a large group of students here in California planning on forming our own student union,” said Georgiou.

After leaving the building’s lobby, satisfied with proof that the consulate had faxed the group’s demands to Canadian Premier Jean Charest, Occupy CCSF organizer Janice Suess thanked the crowd for coming out.

“Not only are we in solidarity with the students in Quebec,” said Suess, “but we’re building our own movement here.”

Art breakthroughs and country music with Sonny Smith

Sonny Smith’s dedicated yet freewhelin’ attitude towards life and art have brought him to his ninth record release this week, Longtime Companion (Polyvinyl Records), with his band the Sonny & the Sunsets. Yes, amid traveling to Central America, undertaking the sprawling “100 Records” art project, writing and performing monologues, and providing scripts for theater and film, Smith found the time to record yet another album.

A longtime San Francisco music scene fixture, Smith is now giving the North Bay a try, specifically San Rafael, with his 8-year-old son. That said, Smith is nowhere near slowing down on his prolific cycle of creativity. His new record has a diverse, country edge. The title track from Longtime Companion features enough flute-work to feel reminiscent of Nick Drake, while the track “Year of the Cock” has a straight-up Johnny Cash vibe.

I spoke to Smith over the phone about his album release, songs as comics, and how having a family has changed his outlook as an artist. Sonny & the Sunsets play Amoeba Music San Francisco tonight:

SFBG How did your time in Central America affect your songwriting and creative influences?

Sonny Smith It was the first time I had my own breakthrough. I wrote a screenplay. I was sitting around playing guitar, trying out songs, and the screenplays became songs. I began writing songs that were linear stories with characters and plots and that stuck with me for years – it started there.

SFBG I read in an interview that after your “100 Records” project ended, you were interested in undertaking another huge project called “Record Plant” – are you still planning to get back to that?

SS Yes I have been thinking about that but it’s morphed into a project called “Protest Factory.” People would come make protest signs, like posters, and musicians would make songs to go with the signs. I would like the poster-making to be open to the public, not just artist friends such as musicians.

SFBG Do you visualize your songs in images, like the record covers musicians made for your project? Or is storytelling your main focus?

SS They go together: sometimes I draw comic panels first for a song idea, like a storyboard. It is like making a little mini movie, I draw it out and fit it all together. Sometimes in the end I discover it’s actually not a song, it’s a visual thing. It is a strange, weird process.

SFBG Did the recording process of the new album feel like a breeze compared to the “100 Records” project?

SS It was very casual, with a couple of friends, when we had time. Actually the “100 Records” project was pretty spread out, so it was fairly casual as well. This time around it was definitely beer cans and afternoons, no uptight studios and all that shit.

SFBG Do you make a point of creating theme albums or does a vibe just strike you as you write?

SS It’s organic. I don’t set out to make a themed record, but songs do come in groupings. It’s natural that you write a few songs and they all share a kind of theme. After around five or six songs, you start to see what it is, and that can inform the rest of the record a little bit.

I didn’t set out to make a country record, but since three or four country songs came out, once I had enough, I said ‘Oh yeah, this is definitely a country record.’ Then I decided to work on more country songs because then I knew I had a record. It was not preconceived – it’s midway through that you start to notice a theme.

SFBG How do you decide what will become a script, and what will become a song?

SS You embark on something, and at some point it reveals itself as what it really is and should be – a lot of things change midstream. For example, recently I started out trying to make a novel, and then I realized it just wasn’t meant to be a book; at some point I couldn’t force it, I could see that is what it is.

I did a play-monologue type thing this year. At first it began as comic books, but at some point I realized it was more of a monologue. I try not to deny it too much, and instead let it be what wants to be. My work does change a lot – if a song does not work for whatever reason, for example, then often I realize it is meant to be a poem. On the other hand, if a poem does not translate into a song, then I let it be what it is.

SFBG How did you end up working with Miranda July?

SS I met her when she was making her first movie [Me, You and Everyone We Know] and she read this cool story over music for a project I was working on. We only worked together for an afternoon and sent a few emails back and forth. You can’t really say you know someone or that it was much of an experience from that amount of interaction – well except we did go to Africa together for a brief love affair. [laughs]

SFBG Any other artists you’d love to work with?

SS One person I was thinking of recently is basically an intangible goal: when I was watching Moonrise Kingdom I was thinking that if I met Wes Anderson, I would see if he wanted to make a sci-fi movie with me. It’s unlikely, but you never know!

SFBG What is one really memorable moment of inspiration or just something that really stands out over your career so far?

SS There are great moments where you feel like you have broken through something – a personal breakthrough, where you did something you had in mind. If I happen to be with other people when that happens, it is exciting. When I was in Central America it was a pivotal moment where I said ‘What is being made here? This is really cool!’

The “100 Records” project came about because the visual artists – that ended up making the record covers –  were making covers that were going to be sketches inside a book. Then the art eclipsed the book idea. It was scary, I thought ‘Oh man, I have to do this?!’ Exciting too. I think it’s good to get in over your head, so you have to hike out, as long as it’s not too hard.

SFBG Do you have a particular place where you’ve enjoyed performing most out of all your travels thus far?

SS
The Make-Out Room feels like home. [Also,] we have played at a grocery store in Portland, right next to the broccoli. There was no sound system or stage, I just know the manager and we enjoyed playing there.

SFBG What made you choose San Francisco as your home base, and what’s your take on the current Bay Area music scene?

SS I was born here and left for a while – but when I came back, it was more like coming home. I don’t know if I would be staying for as long if it wasn’t for my 8-year-old girl. I try not to think about it too much. It’s an exciting music scene – but I think it has always been exciting and always will be, some years it just gets more attention than others.

How has having a family changed your approach to making art?

SS In the earlier years before they go to school, you have to exploit the little bit of time you have to yourself. It can help in a way, because once you have obstacles it actually makes your brain synapses work – you create solutions. If I was rich and lived in some pad and could sleep in until noon every day and lounge around a pool, that would not be conducive to being creative. Maybe that’s why often when people make that much money, they’re not as creative anymore. You need a balance. Kids are creative and much more free, so if you let that rub off on you at all then you’ll be effective.

CPMC’s new numbers threaten St. Luke’s and the mayor’s deal

Can San Franciscans trust California Pacific Medical Center (CPMC) not to shutter St. Luke’s Hospital once the company gets what it wants from the city? And has the Mayor’s Office, in its desire to please the business community and building trades, accepted and promoted a bad deal that doesn’t adequately protect the city’s interests?

Those are some of the questions that arose Monday during a hearing on CPMC’s $2.5 billion, multi-hospital development proposal before the Board of Supervisors Land Use Committee when officials from the Mayor’s Office revealed that the development agreement they negotiated with CPMC might not be good enough to keep St. Luke’s open.

As we’ve reported, CPMC (a subsidiary of Sutter Health, a not-for-profit corporation that nonetheless has a well-earned reputation for profiteering and other bad corporate behavior) is seeking to build a 550-bed regional luxury hospital atop Cathedral Hill. In exchange, the development deal requires CPMC to rebuild St. Luke’s, a seismically unsafe hospital in the Mission District that is relied on by many low-income San Franciscans (as well as the city, which would otherwise have to shoulder more of that burden at General Hospital).

After years of stalled negotiations between CPMC and two consecutive mayors, Mayor Ed Lee announced a deal in March that would have CPMC build a smaller version of St. Luke’s (with just 80 beds) and agree to keep it open for at least 20 years as long as CPMC’s operating margins didn’t dip below 1 percent in two consecutive years.

Activists had criticized the deal as too small, too short, and without enough guarantees, but Mayor’s Office officials have consistently said they were confident it was enough to keep St. Luke’s from being shuttered. But now, based on new revenue projections offered by CPMC, even those officials have lost confidence in the deal and say it needs to be renegotiated.

“These new 2012 projections, while still showing CPMC will not breach the 1 percent margin, do not offer the same comfort level we previously had,” Ken Rich of the Mayor’s Office of Economic and Workforce Development told the committee.

The news hit like a bombshell, shaking the confidence of even supervisors who strongly supported the deal, such as Sup. Scott Wiener, who called it a “surprising, critical piece of information” and said, “It’s very, very important that this issue is quickly resolved.”

For supervisors who were already skeptical of the deal and CPMC – such as Sup. David Campos, whose District 9 includes St. Luke’s – it was further evidence that this was a bad deal that needed more work before being brought to the board. The Planning Commission has already approved the project and the full board was scheduled to consider it in just a few weeks.

“What does that say about the way the negotiation was done?” Campos told us. “How half-baked can something be? What have we done to verify the numbers that CPMC gave us? And what does this say about CPMC?…If the numbers on St. Luke’s aren’t accurate, how can we trust the rest of what they’re telling us?”

Yet during the hearing, when Campos tried to get reassurances from CPMC officials and requested that the board be allowed to review the company’s financial records, he was rebuffed and belittled by CPMC attorney Pam Duffy – who later tersely apologized for her comments after Committee Chair Eric Mar criticized them as “insulting to the board.”

Campos had questioned Rich about why the city was relying on CPMC rather than independently assessing the numbers. “Maybe if you had done an audit, you wouldn’t be in this position of being surprised by the numbers that were given to you,” Campos told Rich.

But Rich said “projections are guesses, we can’t ever guarantee that they are right,” noting that CPMC had revised its revenue estimates downward for the years after St. Luke’s would open (when it would be absorbing the high costs of construction), making its profit margin slimmer. “CPMC took a more conservative approach to forecasting the rate of increase in hospital charges as well as patient volumes in light of the greater uncertainty in health care finance,” Rich said.

So Campos asked whether the supervisors could review CPMC’s data. Rich, who has reviewed it, replied, “The conditions under which we were shown CPMC’s projections is that those are confidential.”

Campos noted that it is the board’s job to review and approval this deal to determine whether it’s in the city’s best interests, which shouldn’t simply involve trusting CPMC. “Why should the executive branch of the government see those numbers but not the legislative branch?” he asked.
“It’s really not our call,” said Rich, noting that he had no objections to the request.

But when Campos asked CPMC’s Duffy, she offered a legalistic refusal, and when Campos tried to explain his reasoning, she said, “I heard your speech a moment ago” and added, “this isn’t really a game of gotcha.”

When Campos said the board was simply exercising its due diligence over an important project. she said “nothing unusual or untoward has occurred here, and the suggestion that might be the case, I think it unfair.”

But Campos wasn’t alone in wanting more reassurance from CPMC, who supervisors, labor leaders, and community activists have criticized for its secrecy and bad faith negotiating tactics with both the city and its employee unions.

“This announcement is shocking, on a number of levels,” Board President David Chiu said at the hearing, noting that he had met with CPMC officials just days earlier and they hadn’t mentioned the new developments, instead assuring him that their operating margins were high and the deal protected St. Luke’s. “It’s not a great way to build the trust we’ll need to move this forward.”

Rich said he had learned of the new numbers 12 days earlier, drawing a rebuke from Campos and others who said the supervisors should have been notified earlier. But Rich said that he was hoping that the problem would be solved through negotiations with CPMC before the hearing, but that talks over the issue have so far been fruitless.

“We would have vastly preferred to have an agreement in hand,” Rich told the committee, reassuring the supervisors that the Mayor’s Office will not support the project until the St. Luke’s issue is resolved to its satisfaction.

But Sup. Malia Cohen criticized CPMC as an untrustworthy negotiating partner. “CPMC has an interesting corporate culture,” she said, noting that the company has repeatedly misled supervisors and community leaders, accusing it of being “disingenuous in its negotiations.”

Chiu emphasized that this is a make-or-break issue: “This is an escape clause that could allow St. Luke’s – and what St. Luke’s means to the city – to not be operational. So this is an incredibly important question.”

Campos said this latest episode only added to his suspicion that CPMC will play games with its finances to shutter St. Luke’s – whose construction must be completed before CPMC can build Cathedral Hill Hospital – once it gets the lucrative regional medical center that it really wants.

“How do we know they aren’t transferring money out of CPMC into Sutter in order to shut down St. Luke’s?” Campos said, adding that he wants to see a clear guarantee that St. Luke’s will remain open as a full-service hospital. “This deal, as far as I’m concerned, is not ready for prime time.”

Mayor vs. Mirkarimi

For all the lawyers, investigators, witnesses, politicians, and political appointees involved in Mayor Ed Lee’s official misconduct case against suspended Sheriff Ross Mirkarimi, this case is ultimately a battle between these two politicians, who come from rival ideological camps — and have a lot riding on the outcome of their clash.

And this week, both Mirkarimi and Lee are expected to take the witness stand and face tough questioning from each other’s attorneys.

These first two rounds of live testimony before the Ethics Commission — which has been painstakingly setting up procedures for its inquiry, defining its scope, and making myriad rulings on what evidence and witnesses to allow — could be the emotional high point of hearings likely to drag on throughout the summer.

On June 28, after the commission finishes ruling on the admissibility of evidence — dealing mostly with the controversial testimony of Lee’s star witness, Ivory Madison, the neighbor who triggered the police investigation that found Mirkarimi had grabbed his wife’s arm during a Dec. 31 argument — Mirkarimi is expected to take the stand.

Given the tacks taken by each side so far, the deputy city attorneys representing Lee will likely try to ask Mirkarimi a broad array of questions about his actions and their wider implications, while his attorneys will seek to limit the line of inquiry to what they see as the narrow question of whether he committed specific acts of official misconduct.

“They’re going to want to blast him with every single issue they can conjure up,” said Mirkarimi attorney Shepherd Kopp. But he thinks the Ethics Commission “will limit it consistent with how they’ve been ruling on our objections,” which has already greatly limited the case that Lee sought to present.

The next day, Lee is scheduled to take the stand, with Mirkarimi’s attorneys planning to question the mayor about why he didn’t conduct an investigation or seek more input from witnesses or former mayors before demanding Mirkarimi’s resignation and suspending him without pay in March.

“The suspension was not done carefully with the best interests of the city at heart. It was a rash political decision that had little to do with the facts,” Mirkarimi’s other attorney, David Waggoner, told us.

Indeed, the city didn’t begin gathering evidence until after the charges had been filed, and since then Lee and his team haven’t been able to unearth much evidence in support of his most damning allegations that Mirkarimi tried to dissuade witnesses and thwart the police investigation, something that Mirkarimi and his attorneys have adamantly denied. In the absence of that evidence, Waggoner said Lee has stepped up his efforts to defame Mirkarimi publicly.

Lee told reporters on June 19 that he suspended Mirkarimi because he was “beating his wife,” seeming to escalate the characterization of a single arm-grabbing incident. The city has also released the video that Madison made of Mirkarimi’s wife tearfully recounting the incident and the couple’s text messages, which made Mirkarimi look bad but don’t offer much new information or evidence.

“He’s panicking. The ship is going down and he’s beginning to flail,” Waggoner said of Lee’s recent statements and actions. “The more the mayor uses that kind of rhetoric, the less credibility he has.”

We sought responses and comments from the press secretaries for Lee and the City Attorney’s Office, but both refused to comment for the record.

Ethics Commission Chair Benedict Hur has taken an increasingly strong role in running the hearings and limiting the ability of either side’s attorney to control them. At the June 19 hearing, he cut off Deputy City Attorney Sherri Kaiser at least twice when she tried to offer unsolicited comments, at one point causing her to get visibly agitated and declare, “I’m objecting to the procedures for objecting to evidence.”

But Hur didn’t relent or modify his approach, telling her, “We are trying to conduct these proceedings in a fair and expeditious way.” Waggoner praised the way Hur has run the hearings so far: “I think he’s been fair in his rulings and how he’s conducted the process.”

After this week’s pair of hearings, the Ethics Commission is scheduled to reconvene its inquiry on July 18 and 19, when it will likely hear from Madison, whose testimony could make or break the case. But first, attorneys for each side are meeting this week to decide where they can agree to limit Madison’s testimony, with the commission making rulings on realms where the two sides differ. Deputy City Attorney Peter Keith has previously said he expects Madison to face tough questioning in which her credibility will be attacked, but the commission itself has already criticized her written declaration and greatly limited her hearsay accounts of life in the Mirkarimi household (see “Ethics Commission undercuts the main witness against Mirkarimi,” June 20, SFBG.com Politics blog). And Kopp told us, “If I get most of my objections sustained, I may not need to cross examine her, as fun as that might be.”

No more fast food: Slow Sex Symposium proposes a love beyond capitalism

After a hectic Pride weekend, it’s about time to slow down. A Sat/30 performance-workshop (part of this week’s stellar This Is What I Want performance art fest — read Guardian theater critic Robert Avila’s enlightening interview with artistic director Tessa Wills here) should fit the bill nicely. Introducing “Slow Sex Symposia” and its curator, internationally-acclaimed writer and dancer Doran George. George is planning an afternoon exploration into alternative sexual practices, lifestyles, and unique relationships. Slow sex is a term the artist coined to serve as counterpoint to today’s fast-paced, commercialized notions of sex. Last week, George and I spoke about what it was like to work with a blockbuster lineup of artist, “the economics of queer desire,” and a childhood solo of  “Yankee Doodle.”

San Francisco Bay Guardian: Tell us about the slow sex movement. What makes it important?

Doran George: Slow sex is not a movement as far as I know. It’s a term that I coined for the symposium because I like the idea that communities of alternative sexual practice are engaged in the long-term process of cultivating a culture of sex that takes time, in contrast with the immediacy of practicing conventional ideas about sex. 

Setting up a good SM scene, negotiating non-monogamy, negotiating racist ideas about the sexuality of non-white bodies while still claiming the space for pleasure, these all take time. There is also a parallel [between slow sex and] the slow food movement, in the sense that I believe the radical pleasure community provides a model of sexual practice that is more nourishing, [similar to how] slow food is better than its fast equivalent.

SFBG: In your artist statement you reference accessibility to touch, conceptualizing new models of relationships, and the complexities of race in the sex industry. Can the slow sex movement move into mainstream and can queer forms of thought (around sex) be integrated into popular culture?

DG: There are many examples of alternative sexual practice entering mainstream culture. Unfortunately most of them are bitterly disappointing. Mainstream culture constantly needs new images and ideas to make it seem exciting, but at the same time it is usually committed to sustaining convention. Take Madonna’s use of SM imagery in the late 20th century as an example. Although some of the aesthetics were tantalizing, the bodies and constructions of gender were incredibly conservative. There were no sexy butch leather dykes on Madonna’s stage or in her videos. 

I think this is partly because the real power of alternative sexual culture is located in the fact that it is something you have learn and practice — it often entails carefully unpicking and rethinking relationships.. All of this takes careful work that is difficult for the fast consumer culture to contend with. In this sense I’m not sure that existing structures for the production and distribution of mainstream culture are very well designed for alternative sexual culture because radical sex depends upon local economy rather than global corporations. 

SFBG:  You are working with a blockbuster cast of queer artists, sex educators, and performers. What was it like working alongside all these influential queer people?

DG: I first heard about radical sex culture when I was in the fourth year of my dance training, nearly 20 years ago. Rachel Kaplan came to my dance academy and gave me a copy of More Out than In which was writing that came out of 848 space about the intersection between art, sex and community. 

A few years later I came to San Francisco from London with an artist’s grant to research diverse sexual cultures. It was 1999 and I was refusing to use gendered pronouns and regularly getting harassed on those big red buses for looking like a freak. When I first arrived in the Bay Area I felt like a queen. Susan Stryker showed me the hot-spots of transgender history and bought me my first\-ever burrito in the Mission. Pat (now Patrick) Califia and Matt Rice took me out for sushi. Annie Sprinkle gave me a pin badge that said “metamorphosexual” on it, and I met with Carol Queen and a host of other San Francisco folk. 

I was overwhelmed by the culture that had emerged in this city, the ideas and practices that people had pioneered, and the history that was being recorded. Returning to the UK I carried on making my own dance works that were influenced by the knowledge I had gleaned from people in the Bay. Being able to create a symposium that looks at how the unique sex culture of San Francisco has informed and been informed by the practice of art is therefore my own way of honoring the people and the gifts I was given as a young queer artists. 

SFBG: What does the term “the economics of queer desire” mean for you?

DG: I’m interested in how conventional economies of desire are queered, or how the queer dimensions of economies of desire become visible. Someone said to me recently that the extra-marital affair is the straight way to play. It made me laugh and struck me as a beautiful queering of heterosexuality, although Carol Queen’s Bend Over Boyfriend is still my all time favorite queering of straight sex.

SFBG: Where does art, desire, and sex intersect in your opinion?

DG: I don’t think that art, desire, and sex ever don’t intersect. Artistic practice has been involved in representing ideals of gender, desire and sex for centuries, and they inform the way that we practice sex. The symposium provides two different frames in which to think, one of them is

performance, and the other is sexual practice, but in reality these things are not separate. Having two frames is useful because it helps to start a conversation by giving us two different ideas to talk about: Performers make their work to represent or express something, and sex radicals do their practice to connect with people erotically (in all the different dimensions that the erotic can exist).

SFBG: How should attendees of the Slow Sex Symposia expect to walk away feeling? 

DG: I hope that attendees will walk away thinking about their feelings, and feeling about their thinking! I also hope their thinking and feeling moves in lots of different directions. My desire for the symposium is that it will provide a space for discourse about sexual and artistic practice to proliferate. A strong culture is one that can contend with diverse opinions being voiced.

SFBG: I enjoyed reading your bio on the This is What I Want website. You are quite an accomplished artist and scholar. Can you tell us something about yourself most people don’t know?

DG: My first major stage performance was a solo rendition of “Yankee Doodle” at the age of nine in the scout gangshow at the amateur dramatic theatre in a working class hosiery town in the British midlands. I don’t think the audience or I ever really recovered!

As opponents of a controversial plan to install artificial turf soccer fields in Golden Gate Park appealed the project’s approval to the Board of Supervisors – with a hearing set for July 10 – they criticized how a soccer coach inappropriately used children to lobby for the project and raised hopes that a new alternative plan would be supported by supervisors.

Responding to the recently approved plan threatening to pave over seven acres of natural grass playing fields in Golden Gate Park, the main organizing opposition, SF Ocean’s Edge, and its attorney, Richard Drury, submitted the 300-page appeal to the board on June 12. The appeal challenges the environmental impact report, citing many of its inadequacies, including the renovation’s aesthetic and environmental inconsistencies with that of the Golden Gate Master Plan and its failure to consider other possibly better alternatives.

The Beach Chalet Athletic Fields Renovation was approved by the Planning Commission and Parks and Recreation on May 24 after a joint hearing that lasted more than six hours. During the hearing, opponents criticized many of the project’s features, but an especially outrageous concern came weeks afterward when a letter from an upset parent began circulating. In the letter, an angry father accuses a Vikings League soccer coach of using his unknowing son as a political pawn to support the renovation project.

“I was shocked and angered to learn that our eleven-year-old son was taken by his soccer coach, without our knowledge or consent, to attend the joint committee meeting in support of converting the Beach Chalet soccer fields to artificial turf.  He was one of the dozens of kids in team uniforms,” said the letter.

The parent said his son was picked up from school and was already dressed in uniform ready for practice but instead was taken to City Hall.

“It is really an outrage,” said Katherine Howard, SF Ocean’s Edge organizer, “to use children to further one’s own agenda instead of having an open and honest discussion.”

Renovation supporters argue that replacing the fields with artificial turf and bright lighting will allow children greater access and contribute to a growing need for more athletic fields throughout the City.

The letter accused the Vikings League of appointing itself speaker for San Francisco’s youth when not every parent or child agrees. And in this case, the boy was said to be in tears after the hearing.

“If my children were brought before a hearing for political purposes,” said Drury, “I would be livid.”

Drury and others maintained the park should be kept as a retreat from the pressures of urban life. Contained in the appeal is an alternative hybrid project that opponents are calling a “win-win solution.”

They propose renovating the playing fields at West Sunset Playgrounds with artificial turf and adequate lighting while keeping the Golden Gate Park fields natural with maintenance that includes adequate drainage and gopher control.

“It’s a very simple and very reasonable alternative,” Drury said, adding that the hybrid plan meets all the objectives of the city’s current proposal and wouldn’t increase the costs.

Although Parks and Recreation were uncooperative and refused to consider the hybrid plan, Drury and Howard feel optimistic about the appeal and think they will have better luck dealing with the Board of Supervisors.

Dueling pot protests precede rejection of a permit appeal

Dueling demonstrations in front of City Hall yesterday afternoon – with one side supporting medical marijuana dispensaries and the other protesting the city’s February approval of three new clubs in the Outer Mission/Excelsior area – preceded the Board of Permit Appeals decision to reject an appeal challenging Mission Organics.

That was the first of the three clubs to pull their building permits to open up shop in a part of the city that currently has no cannabis dispensaries. Yet a group of residents from the region – which includes District 11 supervisorial candidate Leon Chow – has been angrily agitating against the clubs and claiming they expose children to an illegal drug.

Bearing signs that included “Stay away from pot clubs” and “Keep the weeds away from kids” – most in both English and Chinese characters, with a smattering of Spanish translations – the predominantly Asian protesters squared off against a slightly larger crowd of medical marijuana supporters bearing signs that included “Respect Local Law” and “Marijuana is Medicine.” Together, it was a crowd of a couple hundred lining the sidewalk, drawing reactions from passing motorists.

Asked whether he would try to undermine the city’s system of regulating medical marijuana facilities if elected to the Board of Supervisors, Chow told us, “We’re opposing this, but I don’t think it would be my priority.”

Chow said he was “opposing high density,” noting that the Planning Commission approved three dispensaries in the area on Feb. 21, but he also raised concerns that the clubs make it easier for children to get marijuana, that they cater to healthy people just looking to get high, and that city regulations conflict with federal law.

“We don’t want healthy young people to be exposed to people coming out of medical marijuana clubs,” Chow told us. Asked whether he had similar concerns about bars and liquor stores, he said that he did but “there’s nothing I can do” to shut down existing businesses that sell alcohol.

“I don’t want there to be more liquor stores,” he said, although he assured us that, “I’m not a conservative, crazy, church-going Republican.”

Yet supporters of Mission Organics – whose workers will be represented by the United Food and Commercial Workers Union – did call Chow a hypocrite given that he works for SEIU-UHW. “So it’s a union representative opposing a union business,” said Matt Witemyre, an organizer with UFCW who was demonstrating in support of Mission Organics, which he said has agreed to a strict code of conduct that will make them good, responsible members of that community.

“The vast majority of the neighborhood is in support of the project,” Ariel Clark, an attorney representing Mission Organics, told us, characterizing protesters as a small yet vocal part of the neighborhood. The appeal was filed by Steve Currier, president of the Outer Mission Merchants and Residents Association.

Long after most of the protesters on both sides had gone home, the Board of Permit Appeals voted 3-1 to reject the appeal, clearing the way for Mission Organics to open on the 5200 block of Mission Street. But opponents have vowed to continue their fight and appeal the permits for the other two approved clubs – Tree-Med and The Green Cross, a venerable cannabis delivery service – when they apply for building permits.

CHEAP EATS I took a cab from the airport to the football game and changed in the back seat without (I don’t think) leaving anything behind, not even the big bag of smaller bags of airline pretzels. Which came in handy because it was a 6:30 kickoff — an awkward time, whether you’re coming from work, like my teammates, or across the country.

How I came to come by said bag of bags of airline pretzels for entirely free is a restaurant review unto itself, starring a five-year-old girl named Shaya. She got on the plane in Los Angeles with a big bald doll named Jacob, a small Dora the Explorer backpack, and a clipped-on ticket.

“Are you my babysitter?” she said to the stewardessperson, who, as it happens, was standing right next to me while I waited to use the bathroom.

Seatwise, I’d just leapfrogged to an aisle seat in the front of the plane, which you can do on Southwest when it stops to re-passenger.

While I was in the bathroom, the stewardessperson ushered little Shaya to the window seat of my row. When I came out, she apologized. As if!!! “I hope you weren’t planning on having a quiet flight,” she said.

What she couldn’t have known: that I had just said goodbye to two of the many little loves of my life, age 4 and 5, and wasn’t going to see them for one more month, if ever, because — as you know — I have a horrible fear of flying. Every time I step in an airplane I have to assume I am climbing into my tomb.

What neurotic nutcases like me need most in life is a sense of purpose, and here was mine, the moment I’d been waiting for, my “is there a babysitter on board” moment.

“No worries,” I said to the stewardessperson. “I’m a pro.” And I moved my stuff from the aisle seat to the middle one, right next to the girl and her doll so that no one could possibly come between us.

“Is this his first time flying?” I asked, indicating the doll.

“This is my little brother. His name is Jacob. I didn’t have him last time, but mama got him for me. His eyes close when he lays down,” she said. “See?”

I did, and said so.

She leaned toward me conspiratorially and whispered over his head: “He’s not real.”

I whispered back: “Are we?”

She laughed and we introduced ourselves. She was on her way to her dad’s for the summer. Her dad had a new house. She was going to go swimming. I showed her pictures of the Chunks de la Cooter and told her how old they were, and she told me how old she was: Five, like I said. Almost six.

We were hitting it off. Then she got very thoughtful. “I feel awkward,” she said.

“Why?”

“I like you, but my mom told me not to talk to strangers.”

I got a little thoughtful myself. I thought: uh-oh. Was I encouraging unhealthy behavior in a five-going-on-six-year-old?

“Your mom is right,” I said. “You shouldn’t talk to strangers. But the person sitting next to you on an airplane, for as long as you are on that plane, is not a stranger. She is your airplane-only friend.”

This seemed to set Shaya’s mind at ease. In any case, she offered me a Chicken McNugget.

“No thanks,” I said. “I’m still full from last night.” (Comal, the trendy new downtown Berkeley joint with the fancy noise-reduction sound system and way overpriced, way underimpressive food, immediately after which I needed a snack at Phil’s next door: a completely awesome bacon cheeseburger slider with homemade tater tots and my favorite cookie ever, which was essentially a homemade Oreo. Ohmigod, new favorite restaurant ever!)

“What did you eat?” my airplane-only friend Shaya asked.

“Long story,” I said.

After we landed she looked up at me and said, out of the blue: “I was brave.”

“Me too,” I said. “Thank you.”

And the stewardessperson gave me pretzels.

QUEER ISSUE Is San Francisco’s polyamorous community experiencing a renaissance? Pepper Mint, organizer of the recent sex education conference Open SF (www.open-sf.org), suspects the non-monogamous in the Bay Area have finally reached a critical mass. His proof? Over the weekend of June 8, OpenSF was attended by over 500 of the poly-curious and practicing.

It might be, however, that they’ve finally found something to relate to. Sonya Brewer, a somatic psychotherapist, OpenSF lecture facilitator, and queer woman of color, has been a practicing polyamorist for 15 years. Brewer pegged the high attendance numbers on Mint’s efforts to diversify the conference and include sexual minorities and other oppressed groups on its planning committee.

Those values were reflected in the conference’s keynote address, delivered by trans-identified sex educator Ignacio Rivera and transgender health educator and social justice activist Yoseñio V. Lewis. The two hosted a lecture entitled “Kink, Race, and Class,” which sought to inspire dialogue about how social forces play into the world of kink. It was one of the many unique talks over the weekend that both celebrated and critiqued the diversity and spread of the polyamorous community.

Looking over the list of lectures for the weekend — “Sex Work and Non-Monogamy,” “Fat Sluts, Hungry Virgins,” and “Trans Queering Your Sex,” to name a few — it was hard to decide which talks to attend.

I settled on two: Kathy Labriola’s “Unmasking the Green-Eyed Monster: Managing Jealousy in Open Relationships” and the Maggie Mayhem-led “Second Generation Poly.” Labriola’s hour-long talk examined jealousy from an anthropological perspective, highlighting it as a universal experience that manifests itself depending on one’s cultural upbringing. The bad news? Jealousy is unavoidable. The good news? It’s a learned behavior, and you can learn to manage it. Labriola provided us with a handy checklist to use in determining whether insecurities are based in fact or freak-out.

“Identify a situation that makes you jealous and ask the questions,” Labriola advised. “One, [do] I have a resource I value very much and I’m fearful of losing? Two, [does] another person wants that resource.? Three, [do] you believe you are in direct competition for something you want? Four, [do] you believe if push comes to shove you will lose out?” Unless you answered yes to all four, she counseled, your jealousy can be worked through.

Mayhem, dressed in a fluorescent orange space suit (a representation of her “out-of-this-world” situation, she said) sat on a panel with her partner in life and in porn Ned (www.meetthemayhems.com) and his polyamorous family: his father, and his father’s second partner — a non-hierarchical term, Maggie was quick to clarify. Maggie and her family discussed negotiating boundaries at sex parties, raising children with more than two parents, and the stigma parents of sex-positive offspring can encounter.

Given the general focus of Open SF, Maggie’s key advice had resonance: “Be the author to your own happily ever after,” she told us.

The 8 Washington embarrassment

I wasn’t shocked by the vote on 8 Washington. I knew it was happening; I knew we’d lost when the EIR went through. I knew we couldn’t count on a solid progressive bloc any more. I knew that the lobbying was intense.

But I have to say, at the end of the day I was embarrassed. Because the supervisors sold the city cheap.

In the earlier board discussions, Sup. Christina Olague and Sup. Eric Mar mentioned their concerns about the heigh and bulk of the project and said they would work with the developer, Simon Snellgrove, on changes. But the final project was exactly the same size.

Olague and Sup. Jane Kim were concerned about the amount of parking; the developer agreed to cut 50 spaces. But the actual size of the garage won’t be reduced at all; the only promise: There won’t be valet parking, so maybe not so many cars will fit.

Yes, Snellgrove agreed to set aside some scholarships for low-income kids to swim in the pool, which is a great thing and I fully support it. For a project that, according to available figures, will net the developer $200 million in profit — according to Sup. David Chiu’s analysis, a 72 percent rate of return — the scholarship money is peanuts.

There’s an additional 50 cent parking levy to pay for surface improvements in the area.

But as Chiu asked at the June 12 meeting, “Is the city getting an appropriate level of benefits based on Snellgrove’s profits?” Project foe Brad Paul — a veteran of more than 30 years of the city’s development wars — doesn’t think so. “They got nothing,” he told me.

Here’s how it went down:

Chiu started off by introducing the board’s budget analyis, Harvey Rose. Rose said he’d reviewed the finances of the project, and concluded that the city would get $50 million less out of the project than the developer or the Port of San Francisco, which owns some of the land and is a primary proponent, had originally claimed. Chiu also noted that not all the documents were in the file, but nobody else seemed to care.

In fact, through most of the discussion — limited discussion — and final votes, it was pretty clear that nobody was swayed by any of the facts that Chiu put forward. This deal was done long before the board members took their seats.

Chiu offered a series of amendments, none of them terribly radical. He pointed out that the deal requires the city to pay the developer $5 million for open-space improvements. “That’s an anomaly,” Chiu said, and moved that it be removed.

Kim, who throughout the meeting was the strongest supporter of the project, argued that the city often reimburses developers for open space. More, she said, compared to what the city has asked other major residential developers to give, this project is just dandy. “I would not say this is not a fair deal for the city,” she told her colleagues.

The vote on the $5 million giveaway? Developer 6, SF 5. Siding with Snellgrove: Christina Olague, Scott Wiener, Carmen Chu, Sean Elsbernd, Mark Farrell, and Jane Kim. Siding with Chiu and project opponents: John Avalos, David Campos, Malia Cohen, and Eric Mar. It’s an odd lineup — Cohen doesn’t always vote with the progressives, and I have to say it’s strange to see Kim and Olague siding with the four most conservative supervisors.

Chius’s second proposal: Since the city’s benefits were $50 million less than advertised, why not add $14 million to the affordable housing fee?
Developer: 7. Affordable housing: 4. Voting for the developer: Olague, Wiener, Chu, Elsbernd, Farrell, Kim and Mar.

Okay, one last try. Chiu suggested maybe just $2 million more for affordable housing. Wiener, as is he way, went off on his usual complaint that too much of the affordable housing money is for poor people and not enough for the middle class. The final vote:

Developer: 6. Affordable housing: 5. Voting for the developer: Olague, Wiener, Chu, Elsbernd, Farrell, Kim.

Kim, again, took the lead in promoting the deal on the final vote, saying that a parking lot and a private club were not a good use for the space and that “we are achieving here is a higher and better use for the land.” That’s what every developer talks about, by the way — higher and better use.

She also talked about One Rincon, that hideous tower next to the Bay Bridge that was approved after then-Sup. Chris Daly cut a deal with the developer that the San Francisco Chronicle denounced as a “shakedown.

Kim said that, considering the much-smaller size of the Snellgrove project, the benefits were richer than the Rincon deal.

I never liked the Rincon deal — that tower’s a disaster, an ugly scar on the skyline, and there was nowhere near enough affordable housing money. That’s because I think that the city should be building six affordable units for every four market-rate units, that there’s no need for more housing for the very rich and that our current housing policy is a disaster. (The Guardian wrote an editorial at the time that said it was good that Daly had gotten that much money, but was dubious about the whole project. In retrospect, we were too kind.)

I think all my readers at this point know that. So does Daly.

But I asked the former supervisor anyway to comment on the difference between 8 Washington and One Rincon. His thoughts:

1. The Rincon Hill agreement was negotiated by the district Supervisor working together with the communities most impacted by the development. 8 Washington was opposed by the district Supervisor and many nearby residents.
2. Most people in the South of Market were not diametrically opposed to highrise development in that location. The Planning Department had been working on a Rincon Hill neighborhood plan and was recommending upzoning for the area.
3. Rincon Hill had no waterfront trust issues.
4. The Rincon HIll development impact fee was $25 per square foot (over and above the required inclusionary affordable housing fee even though the Mayor’s Office contended that over $20 per square foot would kill the deal.) According to Kim’s release, her 8 Washington deal netted an additional $2 million for affordable housing and a $.50 parking surcharge. This even though development in Rincon Hill is not as valuable as the northern waterfront.

Folks: I think the city got taken to the cleaners here. I’ll stipulate that I’m against this project for much broader reasons. And maybe I’m just an old commie who thinks that the richer you are, the more you should give back, that the affordable housing fees on the most expensive condos in San Francisco should be higher than normal, that if Snellgrove nets $200 million, then the city by definition left too much on the table.

But I don’t think I’m alone in believing that if you’re going to approve something that will make a developer this rich, and let him use public land to do it, on the waterfront, you ought to get your fair share. And that didn’t happen.

Your love: Open SF conference teaches, showcases polyamorous community

“I have a partner that I live with, two girlfriends, and a number of lovers” 

In my San Francisco, it’s not uncommon to know someone who identifies as polyamorous, or who participates in multiple loving and intimate relationships. 

In fact when I talked to Pepper Mint, conference organizer for OpenSF, he told me that the non-monagamous community in the Bay Area has finally reached a critical mass. His reasoning? Over the weekend of June 8, Open SF was attended by over 500 of the poly-curious and practicing. 

As his community expands, Mint thinks it is necessary to recognize the multitude of voices that compose polyamorous San Francisco. “I feel it is important to highlight our similarities while acknowledging our differences,” he told me as we sat on the floor outside of one of the many conference rooms at the Holiday Inn where OpenSF was in full swing around us. 

The weekend started with the Pink play party at Mission Control. There was a keynote address from trans-identified sex educator Ignacio Rivera and trans-gendered health educator and social justice activist Yoseñio V. Lewis. The two also hosted a lecture entitled “Kink, Race, and Class.”

The lecture sought to inspire dialogue about how race, racism, and class appear in the world of kink. It was one of many unique talks over the weekend that both celebrated and critiqued the diversity and spread of the polyamorous community.  Other offerings available to OpenSF attendees included “Sex Work and Non-Monagamy,”  “Fat Sluts, Hungry Virgins,” and “Trans-Queering Your Sex.” 

In another hallway that weekend, Sonya Brewer — who facilitated the “Cultivating Healthy Boundaries” lecture on Sunday — suggested the conference was well attended due to Mint’s effort to include a diversity of individuals, including sexual minorities and other oppressed groups on the planning committee. Brewer, a somatic psychotherapist and queer woman of color, has been a practicing polyamorist for 15 years. 

“It’s about finding out where your yes’ and no’s are to really connect with other people,” said Brewer. “In our culture we get taught not to listen to our bodies. It’s about teaching people their forgotten skills of connecting to themselves.”

Mint described himself to be a straight-leaning bisexual with some gender variance. I watched him push back his shoulder-length purple hair to kiss one of his female lovers hello as he confidently navigated our interview and managed the conference. 

When I asked him to describe his poly structure Mint said, “I have a partner that I live with, two girlfriends, and a number of lovers.” He was raised in a polyamorous home, and talked openly about how his childhood environment help him grow into a healthy, sex-positive community leader. “When creating a sex-positive polyamorous space there is an importance to two things; skills — communication and transparency — and building community connections. People who participate in community usually succeed in polyamory.”

Labriola simply replied, “Just  shut up and listen.”

I left OpenSF feeling newly inspired, and informed about the diverse landscape of the Bay Area’s poly community. The conference encouraged its participants to create doctrines of love while keeping a critical and open perspective. And it provided a place for the polyamorous to come together. “People who try to create their own non-monogamy usually fail,” said Mint. “People who participate in community usually succeed. Being a part of non-monogamous community greatly increases the chance of being successful with non-monogamy, because the skills required are simply not provided by mainstream culture.”

FRAMELINE It was Blue (1993) and Swoon (1992) and Frisk (1995), or My Own Private Idaho (1991) and The Hours and Times (1991). Paris Is Burning (1990). The Incredibly True Adventure of Two Girls in Love (1995).

It probably depended a little on who you were and what you’d seen lately that made you feel grateful to be coinciding with this point on the timeline of queer cinema. For me, it was Lilies (1996) and Go Fish (1997), and All Over Me (1997) and Beautiful Thing (1996), and every other gay teen romance, and any totally f***ed up thing Gregg Araki chose to put onscreen (including 1995’s Doom Generation, billed as “a heterosexual film by Gregg Araki,” which made straight look like a fairly provisional state of being). It was kind of like irony or porn — I couldn’t exactly define it, but I was pretty sure I knew it when I saw it while bingeing, mid–gay adolescence, on whatever the 1990s had to offer in the way of LGBT experience on film. “It” being this thing called New Queer Cinema, a term that film critic and scholar (and past Guardian contributor) B. Ruby Rich had coined in a 1992 essay in the British film journal Sight & Sound.

Rich, these days teaching in UC Santa Cruz’s Film and Digital Media Department, offered up the idea of New Queer Cinema as a way to frame a ragged-edged genre that she saw emerging. Populating it were films that told unfamiliar, upsetting, outrageous, and sometimes deeply lyrical stories of queer experience, forcing a more complicated picture onto the screen. As many of them gained a cultural foothold (seldom reaching deep into the mainstream, but drawing respectable numbers of art-house-goers), they made a space around themselves for more such films to follow their unsettling examples.

Over the next decade and beyond, the genre, and the larger, disparate queer culture, welcomed a world of untold stories; films like My Own Private Idaho and later Velvet Goldmine (1998) and Boys Don’t Cry (1999) entered the popular culture by way of some combination of star and story power; and one morning we woke up to the sight of significant swaths of the country heading to the multiplex to watch a swoony, gloomy tale of two cowboys in love.

Now, somehow, Brokeback Mountain (2005) is starting to seem like a long time ago, and you could say that New Queer Cinema has both evolved and devolved, a fact reflected in the rom-com-packed LGBT section of your friendly neighborhood video store as well as in each passing year’s Frameline festival catalog. This year, the San Francisco International LGBT Film Festival offers the opportunity to compare and contrast, casting its eyes back on the genre 20 years after Rich pronounced its existence and sketched its parameters.

In addition to presenting Rich with its annual Frameline Award, the fest has programmed a retrospective of four films that offer a sense of New Queer Cinema’s expansive scope and permeable borders: Alex Sichel’s dark-and-light, riot grrrl music–infused All Over Me (costarring a baby-faced Leisha Hailey from The L Word); Ana Kokkinos’s Head On (1998), about a reckless but closeted young man living in a tight-knit Greek Australian community; Gregg Araki’s violent, trashily romantic, HIV-inflected road movie The Living End (1992); and Cheryl Dunye’s experimental mix of documentary and dyke drama The Watermelon Woman (1996). (In 2012’s Mommy Is Coming, also screening, Dunye adds to the mix Berlin sex clubs, explicit taxicab-backseat role play, and a parent-child dynamic likely to leave you flinching in horror.)

Elsewhere in the fest, French writer-director Virginie Despentes’s Bye Bye Blondie has a mosh pit soundtrack and follows, clumsily, Araki’s frenetic and unrestrained example. Béatrice Dalle (1986’s Betty Blue) and Emmanuelle Béart (2002’s 8 Women) play former teenage punk rock sweethearts who met in a mental institution and reunite after a long estrangement to reenact the past and rip open old wounds. A high point, though not for their relationship, occurs when Dalle’s slightly unhinged character tells a woman at a highbrow cocktail party, populated by Paris’s public-intellectual set, that her dress is sectarian, before physically assaulting another guest. Cloying and soap operatic, offering the gauzy fantasy fulfillment of a Harlequin Romance, Nicole Conn’s A Perfect Ending nevertheless earns points for its premise of an uptight housewife who employs the services of a call girl — and for casting Morgan Fairchild as a madam who uses her Barbie collection as a staffing organizational tool.

Other queer stories are more successfully delineated. Aurora Guerrero’s coming-of-age tale Mosquita y Mari, which screened at the SF International Film Fest in April, soulfully and subtly captures the ambiguous friendship that develops between two Latina high schoolers struggling with unspoken feelings as well as pressures both familial and financial. In Joshua Sanchez’s Four, adapted from a play by Christopher Shinn, Fourth of July fireworks and a mood of lonely isolation serve as a backdrop to four disparate individuals’ uncomfortable attempts to find physical and emotional connection. Stephen Cone’s The Wise Kids is set in and around a Southern Baptist church in Charleston, South Carolina, and tracks a trio of teenagers as they sort out the facts of their religious and sexual identities.

There’s a startlingly small quantity of queer baby-making going on in this year’s fest compared with recent years, and the family proposed in writer-director Jonathan Lisecki’s romantic comedy Gayby (as well as Ash Christian’s Petunia) is not necessarily nuclear or easy to encapsulate in kindergarten on “Let’s draw our family tree!” day, marrying the concept of queer family to the Heather-has-two-mommies narrative. The film’s gay-boy Matt and straight-girl BFF Jenn decide that it’s time to settle down and start a family together, but reject the idea of turkey basting or consulting a fertility specialist in favor of comically awkward, highly unerotic, goal-oriented sexual intercourse.

Come to think of it, their method could resonate with the procreation-only, can’t-wait-to-be-raptured crowd, who might be less enthusiastic when the pair switch to good old-fashioned DIY insemination and Matt’s friend Nelson (a scene-stealing Lisecki) brings over a container of holy cat cremains to sanctify the proceedings. Either way, with queer spawning sometimes serving as the rope in a tug-of-war argument about heteronormativity, queer identity, transgression, and basic rights, an unruly rom-com about queer family planning is a fitting entry in a genre and a festival that have both grown into panoramic representations of the queer world.

The controversial and long-awaited proposal by California Pacific Medical Center (CPMC) to build a 550-bed luxury hospital atop Cathedral Hill and to rebuild St. Luke’s Hospital has finally arrived at the Board of Supervisors — where it appears to have little support.

So far, not one supervisor has stepped up to sponsor the deal, and board members say it will have to undergo major changes to meet the city’s needs. “There are still a lot of questions that remain,” Sup. David Campos told us, citing labor, housing, community benefits, and a long list of other issues that he doesn’t believe CPMC has adequately addressed. “It tells me there’s still more work to be done.”

CPMC, which is Sacramento-based nonprofit corporation Sutter Health’s most lucrative affiliate, has been pushing the project for almost a decade. Its advocates have subtly used a state seismic safety deadline for rebuilding St. Luke’s — a hospital relied on by low-income residents of the Mission District and beyond — as leverage to build the massive Cathedral Hill Hospital it envisions as the Mayo Clinic of the West Coast.

But the project’s draft environmental impact report shows the Cathedral Hill Hospital would have huge negative impacts on the city’s transportation system and exacerbate its affordable housing crisis. And CPMC has been in a pitched battle with its labor unions over its refusal to guarantee the new jobs will go to current employees or local residents and be unionized. There are also concerns with the market power CPMC will gain from the project, how that will affect health care costs paid by the city and its residents, and with the company’s appallingly low charity care rates compared to other health care providers (see “Lack of charity,” 12/13/11).

CPMC had refused to budge in negotiations with the Mayor’s Office under two mayors, for which Mayor Ed Lee publicly criticized the company’s intransigence last year. But under pressure from the business community and local trade unions who support the project, Lee cut a deal with CPMC in March.

That development agreement for the $2.5 billion project calls for CPMC to pay $33 million for public transit and roadway improvements, $20 million to endow community clinics and other social services, and $62 million for affordable housing programs, nearly half of which would go toward helping its employees buy existing homes.

While those numbers seem large, community and labor leaders from San Franciscans for Healthcare, Housing, Jobs and Justice (SFHHJJ), which formed in opposition to the project, say they don’t cover anywhere near the project’s full impacts. And given that CPMC made about $180 million in profit last year in San Francisco alone — money that subsidizes the rest of Sutter’s operations — they say the company can and should do better.

“This is about standing up to corporate blackmail,” SFHHJJ member Steve Woo, a community organizer with the Tenderloin Neighborhood Development Corporation, told us.

 

PIVOTAL PROJECT

CPMC is perhaps the most high-profile project the board will consider this year, one that will impact the city for years, so the political and economic stakes are high.

The Planning Commission voted 5-1 on April 26 to approve the deal and its environmental impact report, citing the project’s economic benefits and the looming deadline for rebuilding St. Luke’s. The Board of Supervisors was scheduled to consider the appeal of that decision on June 12 (after Guardian press time), but activists say supervisors planned to continue the item until July 17.

In the meantime, the board’s Land Use Committee has scheduled a series of hearings on different aspects of the project, starting June 15 with a project overview and presentation on the jobs issue, continuing June 25 with a hearing on its impacts to the health care system. Traffic and neighborhood impacts would be heard the next week, and then housing after that.

Calvin Welch, a progressive activist and nonprofit affordable housing developer, said the project’s EIR makes clear just how paltry CPMC’s proposed mitigation measures are. It indicates that the project’s 3,000 new workers will create a demand for at least 1,400 new two-bedroom housing units. Even accepting that estimate — which Welch says is low given that many employees have families and won’t simply be bunking with one another — the $26 million being provided for new housing construction would only create about 90 affordable studio apartments.

“We’re going to end up, if we want to house that workforce, subsidizing CPMC,” Welch told us.

Compounding that shortcoming is the fact that the Cathedral Hill Hospital is being built in a special use district that city officials established for the Van Ness corridor — where there is a severe need for more housing, particularly affordable units. The SUD calls for developers to build three square feet of residential for every square foot of non-residential development.

“That would require building 3 million square feet of residential housing with this project,” Welch said. “We don’t think $26 million meets the housing requirement for this project, let alone what was envisioned by this [Van Ness corridor] plan.”

SFHHJJ is calling for CPMC to provide at least $73 million for affordable housing, with no more than 20 percent of that going to the company’s first-time homebuyer assistance program. That assistance program does nothing to add to the city’s housing stock and critics call it a valuable employee perk that will only increase the demand for existing housing — and thus drive up prices.

But the business community is strongly backing the deal, and the trade unions are expected to turn out hordes of construction workers at the hearing to make this an issue of jobs — rather than a corporation paying for its impacts to the community.

“After a decade of discussion, debate and compromise, the city’s departments, commissions, labor, business and community groups all agree on CPMC,” San Francisco Chamber of Commerce President Steve Falk wrote in a June 8 e-mail blast entitled “Message to the Board of Supervisors: Don’t Stand in the Way of Progress.”

“The fate of our city’s healthcare infrastructure now lies solely with the Board of Supervisors,” the Chamber says. “When it comes time to vote, let’s insist they make the right choice.”

Yet it’s simply inaccurate to say that labor and community groups support the deal, and both are expected to be well-represented at the hearings.

 

CARE FOR WHOM?

Economic justice issues related to health care access and costs are another potential pitfall for this project. SFJJHH activists note that no supervisors have signed on to sponsor the project yet — which is unusual for something this big — and that even the board’s most conservative supervisors have raised concerns that the city’s health care costs aren’t adequately contained by the deal.

“There’s a significant amount of dissatisfaction with the deal, even among conservatives,” SFJJHH member Paul Kumar, a spokesperson for the National Union of Healthcare Workers, told the Guardian.

On the progressive side, a big concern is that CPMC is proposing to rebuild the 220-bed St. Luke’s with only 80 beds, which activists say is not enough. And even then, CPMC is only agreeing to operate that hospital for 20 years, or even less time if Sutter’s fortunes turn around and the hospital giant begins losing money.

CPMC Director of Communications Kathryn Graham, responding by email to questions and issues raised by the Guardian, wrote generally and positively about CPMC and the project without addressing the specific concerns about whether housing, transportation, and other mitigation payments are too low.

On the jobs issue, she wrote, “Our project will create 1,500 union construction jobs immediately—and preserves and protects the 6,200 health care professional jobs that exist today at the hospitals. Currently, nearly 50 percent of our current employees live in San Francisco. During the construction phase of this project, we are committed to hire at least 30 percent of workers from San Francisco. We will create 500 permanent new jobs in just the next five years—200 are guaranteed to be local hires from underserved San Francisco neighborhoods. We don’t know where you got the ridiculous idea that our employees must reapply for jobs at our new hospitals. That is incorrect.”

Yet CPMC has resisted requests by the California Nurses Association and other unions to be recognized at the new facility or to agree to card-check neutrality that would make it easier to unionize. And union representatives say CPMC has offered few assurances about staffing, pay, seniority, and other labor issues.

As one CNA official told us, “If they aren’t going to guarantee jobs to the existing employees, those are jobs lost to the city.”

“We’re giving Sutter a franchise over San Francisco’s health care system for 30 to 40 years, so we should ensure there are basic worker and community protections,” Kumar said.

Welch and other activists say they believe CPMC is prepared to offer much more than it has agreed to so far, and they’re calling on the supervisors to be tougher negotiators than the Mayor’s Office was, including being willing to vote down the project and start over if it comes down to that.

“They make too much money in this city to just leave town,” Welch said of CPMC’s implied threat to pull out of San Francisco and shutter St. Luke’s. “It’s bullshit.”

Sutter’s CPMC deal isn’t healthy

At 10am on Friday, June 15, at the main chambers of the Board of Supervisors, the first of a series of public hearings will be held on specific aspects of the  development agreement governing the $1.9 billion Sutter Health/California Pacific Medical Center proposal to expand and centralize the giant health-care outfit’s health center by building a new 555 bed hospital at Geary and Van Ness. The deal involves demolishing the existing 220-bed hospital at St. Luke’s at Mission and Cesar Chavez and rebuilding a new 80-bed facility, expanding the Ralph K. Davies hospital at Duboce and Noe and closing down the old Children’s Hospital in Laurel Heights.

The hearing will be the first before the Board of Supervisors. Thus far, the project has been before only the executive branch: the Planning Commission and the mayor. After a brief introduction on the overall project the hearing will focus on the issue of jobs.

This is the largest project to be negotiated by the Lee administration — and although the mayor introduced it to the board in May, not one supervisor has yet joined him to sponsor the legislation. That’s an an odd situation given the importance of the project – and the fact that Mayor Lee can usually count on an automatic four votes from the conservative faction of the board. But not this time.

The hearing was requested by a coalition of more than 60 community, neighborhood, labor, and environmental organizations — San Franciscans for Healthcare, Housing, Jobs and Justice (SFHHJJ) — which has been closely following the project for the last two years.  Members of the coalition have already appealed the project’s environmental impact report, passed last month by the Planning Commission, and SFHHJJ has developed a series of amendments to the agreement that it has been pressing on the Board of Supervisors.  Board President David Chiu agreed to set a series of hearings on the project before it voted on, along with the determination of the appeal of the EIR, in  late July.  SGHHJJ hopes to use the hearings to get across the serious shortcoming of the agreement.  In addition, depending upon the appeal of the EIR,  a law suit may well be filed by some members of the Coalition.

In short, what starts next Friday is a big deal.

Not only is it a big deal in the development war that is at the heart of San Francisco politics, but it also is a big deal given what may well be done by the Supreme Court in deciding the constitutionality of all or part of the Affordable Health Care Act. If Obama’s health reform is struck down by the court, in all or in part, which seems almost certain, Sutter/CPMC’s plan will most definitely take on even more importance for the future of health care and its costs in San Francisco.

Sutter currently controls about a third of the market for health care in San Francisco.  With the construction of this project, it will control about 40 percent — a portion most knowledgable observers feel will give it market dominance  and an ability to actually set health care costs in San Francisco. Sutter’s business model — as shown in Berkeley when it took over Alta Bates and elsewhere in the state – demonstrates that  with a dominate market position, it jacks up prices.

As the San Francisco Chronicle noted in 2010: “…Sutter Health Co. has market power that commands prices 40 to 70 percent higher than its rivals per typical procedure — and pacts with insurers that keep those prices secret”.

A US Supreme Court that weakens or strikes down health care reform will simply re-establish the status-quo ante, a situation in which Sutter will thrive.

And that’s why the board’s conservative members are not supporting Mayor Lee’s deal: it simply does not protect the city — itself a major health care consumer for both its workforce and Healthy San Francisco — from Sutter’s history of turning market power into high health care charges.

SFHHJJ want the development agreement amended to place a cap on the costs charged to the city, allowing Sutter no more than 115 percent of the average charged  by  San Francisco’s other private, nonprofit hospitals.  It also wants Sutter/CPMC low charity care payments pegged at an average of what other nonprofit hospitals contribute, and it is calling for rebuilding St. Luke’s in San Francisco medically underserved south east to 180 beds, not the sure-to-fail size of 80 beds.

But there’s even more to deplore about the proposed deal.

In housing, although the EIR showed that a demand would be created for some 1,500 new two-bedroom homes, Sutter/CPMC agreed to only provide funds to build about 90 such homes. Such a massive shortfall will boost housing prices all other San Franciscans will pay.

The project’s impact on public transit at the Geary / Van Ness intersection will be large and ongoing. More than 20,000 new car trips will be generated at that intersection by the new hospital. Plans for a Bus Rapid Transit raised roadway for the 38 Geary — the most used bus line in the city — will have to be altered at an unknown price since the project calls for all auto traffic to enter the site on the Geary Avenue side.

Again, San Francisco taxpayers will be on the hook to pay for these new costs.

But it is the jobs aspect of the deal that is the most distressing. Sutter/CPMC has a long history of labor disputes with its workforce. Last year it replaced nurses who took a day off to protest their working conditions, and a replacement nurse hired by Sutter accidentally killed a patient. Sutter/CPMC refuses to agree to hire all of its 6,000 current employees for the new facilities. It’s requiring them all to apply as new workers, losing all of their seniority, with a real prospect that many currently employed San Francisco residents will lose their jobs once the new facility opens. All that Sutter/CPMC has agreed to do is hire 50 residents a year for four years – 200 new local jobs, total.

The  June 15 hearing will focus on the jobs issue and public comment is sure to be hot on this laughable “commitment” agreed to by the “jobs” administration.

Occupy Caravan takes off to the National Gathering

This looks familiar!

Jan. 17, we proposed Occupy Nation, an idea that those energized and organized by Occupy come together on July 4, 2012 for a national gathering to get some planning done. We also proposed that the journey across the US be a part of the action, and that people get together in vans for a freedom-ride inspired experience. Well, it’s happening- although, of course, it wasn’t all our idea. But they are using our cover art!

The Occupy Caravan is an ever-expanding crew of people getting together for a two-week journey across the US. There are two starting points, Los Angeles and San Francisco- and the San Francisco caravan is taking off June 11. The caravans will stop at Occupy sites along the way for protests, education and entertainment, before arriving in Philadelphia for the June 30 Occupy National Gathering.

The poster declares, “bring tents!” But according to an Occupy Caravan organizer known as Buddy, sleeping arrangements that won’t risk police meddling are planned at every stop.

“We have a bunch of secure and fun locations- there’s a slumber party at one, a march and then staying at a church at another, a supporter’s camp ground where we can park the RVs,” said Buddy.

“We’re not risking people getting arrested,” he said. “Everything is legal and nonviolent.”

In theory, anyone who wants to can show up, on foot or with a vehicle, and join the caravan. But if you want to secure a spot, according to Buddy, it’s best to sign up online beforehand.

“We’re getting 30 to 50 calls and emails a day about rides,” Buddy told me of the last chaotic week before the trip launches.

The National Gathering isn’t the only nationwide Occupy plan for this summer. It isn’t the only one in Philadelphia either. Or for the July 4 weekend. There’s also the 99 Percent Declaration, billed as a “Continental Congress 2.0”

It looks like these big get-togethers are part of the form Occupy will take this summer. What with a big and chaotic May Day, an even more tumultuous anti-Nato convergence in Chicago, and continuing home defenses, occupations of public spaces, and innumerable local actions across the country, the Occupy movement is in a very different state than it was in the winter when the Gathering and the Caravan were in their beginning planning stages.

“The movement has grown,” Buddy told me. “It’s less than a year old. It was an infant early on, and grew very quickly, but its getting stronger. We’re going back to the simply core message of economic equality and justice.”

After the National Gathering, the caravan will join the Occupy Guitarmy for its “99 Mile March” to New York. The Guitarmy is a travelling group of musicians that bills itself as “the world’s first open source band,” best known for its march on May 1 in New York City, led by Tom Morello of Rage Against the Machine.

As we said in the Occupy America proposal: “The important thing is to let this genie out of the bottle, to move Occupy into the next level of politics, to use a convention, rally, and national event to reassert the power of the people to control our political and economic institutions — and to change or abolish them as we see fit.” One thing is clear: Occupy hasn’t given up yet.

Time’s on his side

MUSIC Nick Waterhouse no longer calls San Francisco home, but the city’s fingerprints are all over Time’s All Gone, his effortlessly fun, debut LP. The retro-minded songwriter-producer crafts perfect little tributes to the punchy 1950s R&B sounds he’s been drawn to since he was a kid, all steeped with an endearing reverence for old-school record culture and recording techniques.

“We cut as live as possible, so a lot of the record is eight people in one room playing at the same time,” he explains. “Everybody’s gotta feel it together, and if they don’t, you really don’t have a song, in my opinion.”

As a Southern California kid growing up in the Costa Mesa area, Waterhouse approached his music listening from a studious angle, soaking up the Van Morrison and John Lee Hooker records of his parents, along with the Descendents and Sonic Youth albums he found. The well-rounded sonic diet can be heard within the frayed edges and garage rock appeal that Time’s All Gone has in spades.

“I listened to everything I could because I wanted to gain as much experience as possible,” he says. “I was the kid staying up for hours with the radio under the covers.”

By 18, Waterhouse had moved to San Francisco and quickly jumped headfirst into the DJ scene, spinning and building a network of like-minded cohorts at the Knockout’s Oldies Night and Saturday Night Soul Party at the Elbo Room, which brought him in touch with folks like Ty Segall and Mikal Cronin. No connection, however, would become as important to him as his relationship with Rooky Ricardo’s, the Dick Vivian-owned oldies-R&B-soul-centric gem of a record store in the Lower Haight.

“Rooky Ricardo’s informed a lot of how I developed as a person, and it’s all in the spirit of the place,” he says. “It’s got that clubhouse feel.”

Waterhouse recorded the saxophone-propelled blast of “Some Place” in the summer of 2010, an undertaking that he says was fueled more by a desire to sell vinyl copies to friends and fellow Rooky’s shoppers than to start a full-fledged music project.

“I really had no interest in it at the time,” he explains. “I figured I’d just keep making these 45s for fun and no one would even know who I was.”

After some nagging by friends to put something together for live shows, however, he caved and began recruiting players for the beginnings of what is now the Tarots, his perfectly complementary backing band. Together with Waterhouse’s guitar playing and expressive croon, the group uses horns, piano, drums, and female backing vocals to pay tribute to soulful R&B without ever falling victim to hollow mimicry or self-conscious irony. This is warm music made by passionate people with only the purest of intentions.

When it came time to record an LP, Waterhouse did what anyone who’s heard his music might expect and found an all analog studio in Costa Mesa called the Distillery to work out of. With the use of vintage gear, old ribbon mics, and classic recording techniques, he says that Time’s All Gone was constructed entirely with vinyl in mind.

“I can’t lie and pretend that as somebody born in the late-1980s I haven’t had moments of discovery because of digital music,” he says. And while yes, he has found music digitally over the years, he doesn’t have any vivid, concrete memories of those discoveries, the way he does with physical records. “I can still remember what listening station at Rooky’s I was at when I first heard a record, or what weird flea market I found something at. Having something tangible in front of you helps you associate.”

Waterhouse recently moved back to Southern California due to his quickly escalating, hectic tour schedule, but the plan has always been to officially release his album in San Francisco. In a beautiful bout of planning, Wednesday night’s show will not only mark the release of Time’s All Gone, but will also serve as a celebration for the 25th anniversary of the day Rooky Ricardo’s first opened its doors. Expect the dance party to start early and run late, as Waterhouse has enlisted the help of some of his favorite local DJs to spin before and after his set.

“In my mind, my album was born out of Rooky’s and out of a specific period of time in San Francisco more than anything else,” he says. “So this is my party for all the people and things that really mattered to me there.”

The Performant: All you can eat

Wild Food Walks and Bal Littéraire satisfy imaginative appetites.

“First, the bad news,” says our guide and frequent forager Kevin Feinstein. “Foraging in the Bay Area is illegal.”

Well, swell, I guess it’s a good thing that I packed snacks. “If the land is private, and you have permission from the owners, you can forage,” Feinstein amends, which still doesn’t help me in planning my lunch, but good to know for future reference. I’m attending one of ForageSF’s “Wild Food Walks,” along with about 15 others, hoping to graze upon that freest of foodstuffs, the weeds in our backyards — and yours.

The tour kicks off on the perimeter of Golden Gate Park, and without even taking a step, we’re summarily introduced to common mallow, miner’s lettuce, and stinging nettles. After another reminder about the illegality of *picking* the plants in the park, Feinstein exhaustively details each plant’s properties — their nutritional content, the edible parts of each, identification and preparation tips. Mallow is mucilaginous and anti-inflammatory, and the seed pods or “cheese wheels” can be eaten as well as the leaves, stalks, and everything else. Miner’s lettuce, which looks a bit like a land-locked lily-pad, is native to California, high in Omega-3s, and never gets bitter, even when older. Nettles do sting (which one curious child found out the hard way), but not when crushed or cooked. Extremely high in various minerals and vitamins, nettles are also easily cultivated, making them a good bet for amateur urban farmers as well as foragers.

“One five-gallon nursery pot grows more nettle than one person can handle,” promises Feinstein as visions of pestos and cream soups begin to creep into our collective consciousness.

Two hours and a dozen plants later, we’re all a little overwhelmed, but there’s excitement in it, like people are going to go home immediately and weed the garden, not for the usual reasons, but to make a salad. It almost makes one want to trade one’s wallet for a foraging basket, until reminded that urban foraging has its share of downsides — legal issues, contaminated soil, plant misidentification. Even so, I’m betting that hardly anyone in that group will be able to pass by a big clump of hilltop-dwelling nasturtiums or wild radish without checking for their crunchy, spicy seed pods, or slipping a few leaves in their bag for later.

Another new taste I was introduced to over the weekend was San Francisco’s first ever “Bal Littéraire,” a Parisian concept imported over as part of the French-American translation exchange, the Des Voix Festival. Though I’d been given an idea of the concept ahead of time — an ephemeral, collaborative work created by six playwrights, using pop songs to tie the scenes together and turning the floor into a giant dance party — nothing could have prepared me for the high-spirited spectacle it became.

Seeing a “typical” Bay Area theatre crowd getting down and dirty to hyphy hit “Fast (Like a Nascar)” in the middle of a French-accented, surrealistic serial romantic comedy featuring Liz Duffy Adams as a tough-talking, Jackie-of-all-trades stalking a middle-aged French divorcee, and Marcus Gardley as an octogenarian in drag, was a taste of contemporary France mixed with a Bay Area spice that titillated a cosmic palate, and won’t soon be forgotten. Here’s hoping that either Playwrights Foundation or the Consulate General of France find a way to keep this new theatrical tradition going in SF for years to come.

EDITORIAL It's something of a civic shame that the only way San Francisco can build a new transit terminal is to sell a private developer the rights to stick a 1,070-foot highrise office tower on public land. In fact, it's a sad statement on the city, state, and local government: Once upon a time — and it wasn't the long ago — tax dollars collected through a progressive system paid for major infrastructure projects.

But there's no easy way to raise $4 billion in tax money for the Transbay Terminal — even though it ought to be seen as part of the high-speed rail project, and the federal and state government ought to be picking up the tab. So San Francisco ambles forward, selling land and lease rights to the highest bidder.

In this case, Gerald Hines of Houston won the right to build the largest highrise west of the Mississippi on property owned by the Transbay Joint Powers Authority. There are all sorts of drawbacks to the deal — among other things, it will cast shadows on a number of city parks, all the way to Portsmouth Square in Chinatown. Like any massive office complex, it will put pressure on Muni, on city streets, on police and fire and other city services — and no commercial office building ever pays its fair share of that burden. And since in this case the major recipient of the money from the project will be the TJPA, the city's General Fund will suffer.

Oh, and the building is ugly.

Meanwhile, city planners want to increase height limits all around the Transbay Terminal and allow hundreds of units of new (luxury) housing and more commercial office space. It's going to be a new highrise neighborhood, complete with a rooftop park and a few little patches of ground-level open space, which won't get a whole lot of sun, particularly in the morning and evening.

And at this point, there's been very little focus on what ought to be the defining issue of this and the other major developments on the city's planning horizon, and that's affordable housing.

This city has a terrible jobs-housing mix. The vast majority of the people who currently work in San Francisco can't afford to buy a house here, and many of them can only rent if they pay for more than the federal standard of one-third of their income for housing. So people who work in hotels and restaurants and city, state and federal offices and hospitals and even financial district companies wind up living far from the city and commuting. Nobody thinks that's a sound environmental policy.

And this kind of full-scale rezoning and development will only make it worse. According to the City Planning Department, the Hines project will pay about $27 million into the city's affordable housing fund, enough to pay for maybe 60 or 70 housing units. That won't even begin to cover the need created by the thousands of employees who will fill that tower. The market-rate housing on the site will almost certainly be beyond the reach of most San Franciscans, and probably many of the office workers who fill the Hines building. And only 35 percent of the new housing — at maximum — will be affordable.

San Francisco has to get a grip. The city can't keep allowing more high-end housing and highrise office space without a plan to meet its housing needs. We're glad to see the mayor talking about a $50 million a year fund, but that will barely meet existing needs; it can't possible keep pace with new development.

So before the supervisors rush ahead to approve this ambitious new downtown district, they need to ask Hines, and the TJPA, and any other developer who comes along, how it intends to meet the demonstrated need for affordable housing that these projects will create — and demand a much higher level of payment that what's currently on the city's books.

Reduce, re-use, replace

Greg Gaar knows the names, characteristics, and birds and butterflies attracted by every plant in the native plant nursery that he tends. Last week, he proudly toured me through the garden, pointing out plants like Yarrow ("great for bees and butterflies") and the beautiful flowers of the Crimson Columbine, of which Gaar believes there are "only two others left in San Francisco."

Gaar has been working at 780 Frederick St., where he now tends the garden, for decades. His mother went to high school on the same block, the old site of Polytechnic High. Before Gaar became the gardener, he ran the recycling center that Haight Ashbury Neighborhood Council (HANC) operates next to the garden. Now, the pioneering green operation he helped build may shut down.

At the center, people can recycle their bottles, cans, paper products, and even used vegetable oil, and make some cash along the way. Those who use the center say it's a green and dignified way to make some money.

But residents in the surrounding area have complained for years that the center is loud and attracts homeless people. They also say that, due to their proximity to the recycling center, the chance that their trash will get rifled through at night is greater than in other parts of the city.

Citing these concerns, the center's landlord, the San Francisco Recreation and Parks Department (RPD), has spent the past few years trying to evict the HANC recycling center. The center got an eviction notice in December 2010. HANC's lawyer, Robert DeVries, successfully challenged the eviction. RPD sued for eviction again in June 2011, and that matter may finally come to a close June 6 when it will be heard by a three-judge panel in SF Superior Court.

DELIVERING THE GARDEN


RPD officials cite neighbor concerns, claims that the recycling center's services are outdated and obsolete, and the idea of planting a community garden in its place. In fact, the Planning Commission approved a community garden in the place of the recycling center last year.

Since then, HANC staff got to work building its own community garden. In just a year, they erected 50 beds from recycled wood, and according to Gaar, about 100 neighbors have plots that they currently tend.

As the recycling center's director, Ed Dunn, tells it, the infrastructure already in place at the recycling center made building the garden come naturally. HANC was able to fund it with income from the recycling operation, and plant it with seeds from the native plant nursery.

Dunn emphasizes that no city money was used to build the current community garden. The city had laid out a $250,000 budget for the garden after it was approved and designed in 2010.

A bundle of documents containing arguments against HANC, provided by RPD, includes details of the Golden Gate Park Master Plan, surveys indicating a great need for community gardens in San Francisco, and letters and statements from neighbors complaining about the recycling center.

A 2004 survey discussed in the documents found that community gardens are among the top "recreation facilities most important to respondent households." Community gardens came in fifth in importance, after walking and biking trails, pools, fitness facilities, and running and walking tracks. The documents include a detailed map of the "Golden Gate Park community garden preliminary plan," imagined at HANC's current site.

The map was drawn up in November 2010, the same month that a meeting of the Recreation and Parks Commission laid out the reasons that HANC had to go. Minutes from the meeting include the city's need for community gardens as well as some neighbors' disdain for the recycling center in that site. It argues that the needs of recyclers can be well met with other recycling centers in the city.

Seventeen other recycling centers operate in San Francisco. Most are located in neighborhoods on the city's edges, with a few in the Outer Sunset and Excelsior, although most are located in Bayview-Hunters Point.

But the commission doesn't seem concerned with potential nuisance to neighbors in directing more traffic to these other recycling centers, or with the difficulty poor recyclers have in getting out there. "The San Francisco Department of the Environment is confident that recyclers that use the facility will take their material to another existing site for proper handling," according to the meeting's minutes.

The commission is, however, concerned about a nuisance that the recycling center creates for Haight-Ashbury neighbors, according to the minutes. The notes cite "neighborhood noise, truck traffic, litter, and public safety concerns as negative impacts related to continuing operations at the site."

AGAINST THE POOR?


But is this really just another case of resentment against people who are poor and homeless?

HANC's Dunn argues that, in fact, much of the material that those who use the center bring in isn't taken from residential waste bins. Besides, it's not technically "HANC's CRV redemption program" that encourages recycling as a revenue source for the less fortunate. State law requires that consumers be able to redeem bottles and cans for cash.

The meeting minutes argue that the recycling center "enables illegal camping and illicit and unhealthy behavior in Golden Gate Parks' eastern end and in neighborhoods in close proximity to the site."

Supposed evidence for the position cites letters to the editor published in the San Francisco Chronicle, a frequent outlet for anger at the homeless. One concerned resident, Karen Growney, asserts that the center "provides no benefit to people living in Haight/Cole Valley."

HANC disputes this, saying that many neighbors use the center. They have beneficial relationships with many nearby businesses, including New Ganges restaurant just across the street. Its website, kezargardens.com, shows many smiling neighbors who use the center to recycle.

Notable among them is actor/activist Danny Glover, a Haight resident since 1957. In a video on the website, Glover — interviewed while in his car dropping off recycling at the center — says, "I would be dismayed and not happy if we close this wonderful recycling center down…It would be a tragedy, and a great loss to this city and this community."

In her letter, Growney also laments that her family "had to pay a considerable amount to build a wrought-iron, locked gate to keep people out of our trash." Another letter, written by neighborhood resident Curtis Lee, asks that the city "eliminate the Haight Ashbury Recycling Center," saying that, "It is a blight on the neighborhood and an attraction to rodents and homeless carts."

Of course, those carts come with people. HANC takes issue with the assertion that their services "enable" or "encourage" homelessness, as well as the assumption that the recycling center only serves the homeless.

Dunn says that many of the recycling center' clientele are elderly immigrants, often housed, who contribute to their family income with cash from recyclables. He also insists that "most of the people that use the recycling center don't camp in the park."

Homeless people certainly do use the center, but it's not clear whether its presence truly "enables illegal camping and illicit and unhealthy activity." Dunn finds it laughable to say that "the center creates homelessness." It's a lot of work to cart around recyclables all day, he says, and the dedicated recyclers are generally not the same people that ask tourists on Haight Street for spare change.

THE RECYCLERS


There is a great diversity in how homeless San Franciscans spend their days, and recycling is in many ways a specialized, committed way of life. In her 2010 ethnography of homeless San Franciscans, Hobos, Hustlers and Backsliders, Teresa Gowan focuses on the "recyclers," the segment of the homeless population who have made a habit of collecting bottles and cans as a way of getting by.

"The phenomenon that captured my interest was the steady stream of shopping carts loaded high with glass, cans, cardboard, and scrap metal rolling past my door," she wrote.

Some of her interview subjects show disdain for the recyclers, who work hard all day and don't get much cash out of it. Dealing drugs, stealing, or panhandling can be more lucrative and less backbreaking. One subject, a man named Del who, according to Gowan, mostly stayed in the Tenderloin, thought the "20, 25 bucks on a big load" that recyclers usually made was pathetic. "'And that's for heaving around a big old rattling buggy all day,' Del said pityingly. 'I can make 15 bucks inside'a two minutes.'"

But many of her interview subjects prefer to recycle anyway. Gowan describes another subject, Sam, as "a champion recycler, muscular and persistent, who often put in nine, ten hours on the trot." She quotes Sam saying, "Without this, I'd kill myself. Couple a days, I'd do myself in…. You get some guys, seems like they can deal with homelessness. I'm not one of them."

The book argues that "pro recyclers" included a "large core group who had created an intense web of meaning around their work as a kind of blue-collar trade."

PIONEERING HANC


Recycling for cash may not be a respected or taxed job "blue collar" job. But it's certainly green.

Since the center began operating in the 1970s, mainstream attitudes towards environmentalism and sustainability have shifted dramatically. The HANC recycling center was a product of the environmental movement, and helped usher in the widespread support for recycling.

Now, with curbside recycling fully functional in San Francisco, many call the recycling center's work obsolete. But HANC argues that the city needs all the help it can get if it is to reach its goal for zero waste in 2020. It also employs 10 people, and Dunn argues that it would be foolish of the city to eliminate those stable green jobs.

HANC has also helped move along the trend towards community gardens that RPD is now embracing so thoroughly that, ironically, it could lead to the recycling center's demise. HANC helped underwrite the Garden for the Environment project as well as the Victory Garden planted outside City Hall in 2008. Dunn says that the staff enjoyed the challenge of building the garden, and would be interested in helping the city by creating more gardens without city money.

Gaar says he's committed to continuing to work for a healthier planet, regardless of what happens to the center. He and the other HANC staff have come to see the eviction process as symbolic of a direction in which the city's heading, that also includes last year's Sit-Lie Ordinance: decisions designed to shuffle homeless people out of wealthy neighborhoods.
The arguments for the community garden, however, seem to indicate a strong desire for a greener city. It's not easy balancing environmental initiatives with NIMBY woes — especially when your backyard is Golden Gate Park.

City weighs artificial turf fields in Golden Gate Park

[[UPDATE 5/25: The project was approved]] The San Francisco Planning and Recreation & Park commissions will hold a special joint hearing tomorrow (Thurs/24) afternoon to consider approving the Beach Chalet Athletic Fields Renovation, a controversial city proposal to replace the natural grass fields on the west end of Golden Gate Park with artificial turf.

The $48 million project – years in development by Recreation & Park officials and championed by department head Phil Ginsburg, who has aggressively tried to monetize the city’s parks – has inflamed the passions of both supporters and opponents, who are expected to jam into the 3 pm hearing in City Hall’s Room 400 to deliver hours’ of testimony. [Correction: Patrick Hannan with City Fields Foundation says this is a $14 million project, part of its overall $48 million artificial turf program for the city.]

Supporters say there aren’t enough fields in the city for young soccer players and the existing fields there are in bad shape and without adequate lighting. In addition to the artificial turf, which the City Fields Foundation (created and funded by the Fisher family, founders of The Gap) has been helping to install in parks throughout the city, the project would include 150,000-watt lighting 60 feet in the air to illuminate the fields until 10 pm, year-round.

Opponents of the project, which include primarily environmentalists and park neighbors, cite a litany of problems with the project, saying it violates city plans that call for the park to remain a natural area open to all park users. They say it will disturb wildlife, increase traffic (much of it from out-of-towners who rent the fields), and create potentially toxic runoff in a sensitive habitat.

“Golden Gate Park is a unique, magnificent, and world-famous San Francisco treasure. It was conceived to serve as an open space preserve in the midst of San Francisco – a cultivated pastoral and sylvan landscape. It was designed to afford opportunities for all to experience beauty and tranquility. Plastic fields that are brightly lighted until 10 pm every night of the year are entirely out of place in this setting. The western end of Golden Gate Park should remain a part of the cohesive naturalistic environment envisioned by the Park’s creators,” Katherine Howard of SF Ocean Edge, which organized in opposition to the project, wrote in a May 22 letter to the two commissions.

While it will be a joint hearing, the Planning Commission is charged with approving the project’s environmental impact report and the RPC will consider approval of the project itself. But judging from the long list of angry comments to our last story on the subject by people on both sides of the debate, this divisive project will likely be the subject of appeals and lawsuits for months or years to come.

Outer Mission opposition

HERBWISE Most medical marijuana dispensaries in San Francisco are clustered around the central part of the city, with the heaviest concentration in SoMa, leaving patients in many outlying parts of the city — such as the Outer Mission and Excelsior districts — with long journeys to visit a cannabis club.

That began to change in February when the Planning Commission approved permits for three new dispensaries to open in the Excelsior: venerable delivery service The Green Cross will open its first brick-and-mortar operation on the 4200 block of Mission, while Tree-Med and Mission Organics each won approval to locate on the 5200 block. All three clubs had been in development for years, delayed by a state case challenging new dispensaries that went all the way to the Supreme Court.

But Steve Currier, president of the Outer Mission Merchants and Residents Association, has appealed the building permit for the first of that trio of clubs to apply for one, Mission Organics, and he allegedly whipped up anti-pot hysteria in the neighborhood that included an April 21 protest march spanning the three dispensary sites.

David Goldman, a member of the city’s Medical Cannabis Task Force, said the Feb. 16 appeal hearing and April 21 demonstration — which he said also included supervisorial candidate Leon Chow — were marked by inaccurate statements that dispensaries attract crime and are harmful to children, even though all three dispensaries are more than 1,000 feet from schools.

“People who are ignorant assume we’re all a bunch of hoodlums or stoners looking to get high,” Goldman said. “We want them to realize that dispensaries don’t bring crime to neighborhood. If anything, it’s the opposite,” he said, citing the value of people, video cameras, and security guards on the street as a crime deterrent, particularly on blocks with vacant storefronts, as is the case with these blocks.

Neither Currier nor Chow returned Guardian calls or emails. Attorney Dorji Roberts, who represents Mission Organics owners Eugene Popok and Mike Mekk, said that he’s also had a hard time reaching project opponents to address their concerns before a Board of Permit Appeals hearing set for June 20.

“We’ve asked them for a meeting recently, but he won’t respond and he can’t articulate any real reasons why he has a problem with it,” Roberts said of Currier and his group.

Roberts said that Popok had attended meetings of the OMMRA to try to integrate into the group and address any concerns it might have, but they were surprised when the project got appealed after being approved 5-2 at the Planning Commission (Tree-Med’s vote was also 5-2, while The Green Cross won unanimous approval), where they saw their first hints of opposition.

“They’re saying it will be a density issue, even though no clubs are out there now,” Roberts said. “They say it will increase crime, which also isn’t true…It’s the same kind of fears and phobias that are offered by people who just don’t like [medical marijuana or its legality].”

Goldman, who had people monitoring the April 21 protest march, said the group would praise businesses along the way while condemning the dispensaries, as one point chanting, “Liquor stores, yes, pot stores, no,” a dichotomy he considers telling of the kind of moralism driving the appeal.

“Fundamentally,” he said, “it’s an attack on patients.”
