Ammiano and Leno seek to reform the Ellis Act and slow SF evictions [UPDATED]

State lawmakers from San Francisco are launching a two-pronged attack on the Ellis Act, which real estate speculators are increasingly using to evict tenants from rent-controlled apartments and cash in on a housing market that’s been heated up by demand from high-paid employees of the booming tech sector.

Assemblymember Tom Ammiano today introduced Assembly Bill 2405, which would allow the San Francisco voters or the Board of Supervisors to declare a mortorium on Ellis Act evictions when the city’s state-mandated affordable housing goals aren’t being met.

Sen. Mark Leno is also planning to introduce his own Ellis Act reforms by today’s legislative deadline for introducing new bills. He’s been working on a reform package with Mayor Ed Lee, but Leno is keeping the details under wraps under Monday at 9am when the pair will hold a press conference outside a Chinatown apartment building to announce their proposal.

Both proposals face an uphill battle in Sacramento given that San Francisco is one of only a couple jurisdictions in the state that have rent control, which Ellis Act was designed to undermine by allowing landlords to get out of the rental business and remove apartments for the market. And the real estate industry industry is expected to strongly oppose the reforms.

“It will, of course, be very difficult, but Mr. Ammiano has been talking about this for months and he’s committed to doing something,” his Press Secretary Carlos Alcala told the Guardian.   

UPDATE 2/24] Leno and Mayor Lee — flanked by other supporters of the legislation, including Sups. David Campos and David Chiu, rival candidates to succeed Ammiano — this morning announced the introduction of Senate Bill 1439. It would authorize San Francisco to prohibit those who buy rental properties to invoke the Ellis Act and evict tenants for at least five years, and only allow only one Ellis Act eviction for the life of each property. 

“The original spirit of California’s Ellis Act was to allow legitimate landlords a way out of the rental business, but in recent years, speculators have been buying up properties in San Francisco with no intention to become landlords but to instead use a loophole in the Ellis Act to evict long-time residents just to turn a profit,” Leno said.

Ammiano Introduces Bill to Stem Evictions from Affordable Housing

 

SACRAMENTO – Assemblymember Tom Ammiano today introduced AB 2405 to empower local jurisdictions to stop the erosion of affordable housing stock.

 

“San Francisco is seeing a terrible crisis,” Ammiano said. “The people who have made our city the diverse and creative place that it is are finding it harder and harder to stay in San Francisco. The rash of Ellis Act evictions has only made it worse.”

Ellis Act evictions are permitted under certain circumstances when a property owner is taking a rent-controlled unit out of the rental market. However, some owners have been abusing these provisions and improperly evicting tenants from rent-controlled units. The problem is not restricted to San Francisco, although the city is going through a particularly critical loss of affordable housing.

AB 2405 would allow local jurisdictions – by means of a Board of Supervisors or public vote – to enact a moratorium on Ellis Act evictions when the local housing element is not met. Also, the bill would hide no-fault evictions from tenant records or credit checks in unlawful detainer cases, and would place Ellis Act unlawful detainer cases on civil court calendars.

“Experience shows you can’t build your way out of an affordable housing crisis,” Ammiano said. “We have to do what we can to preserve what affordable housing we have. This is one piece of that effort.”

SAN FRANCISCO – Senator Mark Leno today joined San Francisco Mayor Ed Lee, other elected officials, tenant advocates, labor groups and business leaders to introduce legislation closing a loophole in the Ellis Act that allows speculators to buy rent-controlled buildings in San Francisco and immediately begin the process of evicting long-term renters. Aiming to mitigate the negative impacts of a recent surge in Ellis Act evictions in San Francisco, Senate Bill 1439 authorizes San Francisco to prohibit new property owners from invoking the Ellis Act to evict tenants for five years after the acquisition of a property, ensures that landlords can only activate their Ellis Act rights once, and creates penalties for violations of these new provisions.

 

“The original spirit of California’s Ellis Act was to allow legitimate landlords a way out of the rental business, but in recent years, speculators have been buying up properties in San Francisco with no intention to become landlords but to instead use a loophole in the Ellis Act to evict long-time residents just to turn a profit,” said Senator Leno, D-San Francisco. “Many of these renters are seniors, disabled people and low-income families with deep roots in their communities and no other local affordable housing options available to them. Our bill gives San Francisco an opportunity to stop the bleeding and save the unique fabric of our City.”

 

Ellis Act evictions in San Francisco have tripled in the last year as more than 300 properties were taken off the rental market. This spike in evictions has occurred simultaneously with huge increases in San Francisco property values and housing prices. About 50 percent of the city’s 2013 evictions were initiated by owners who had held a property for less than one year, and the majority of those happened during the first six months of ownership.

 

“We have some of the best tenant protections in the country, but unchecked real estate speculation threatens too many of our residents,” said Mayor Lee. “These speculators are turning a quick profit at the expense of long time tenants and do nothing to add needed housing in our City. These are not the landlords the Ellis Act was designed to help, and this legislation gives San Francisco additional tools needed to protect valuable housing and prevent further Ellis Act speculator evictions, which has already displaced working families and longtime San Franciscans. This carve out is a good policy for San Francisco, and I thank Senator Leno for being a champion on this issue. Together we have built a large coalition of renters, labor and business leaders to fight this battle in Sacramento to support middle income and working families here in our City.”

My former neighbors and I, working families and seniors, were displaced from the place we called home for several decades,” said Gum Gee Lee. “Those that have yet to receive an Ellis Act notice continue to live in fear, fear that they too will be evicted from their homes. For seniors such as myself who rely on public transportation and access to social and health services within our community, Ellis evictions cut our lifeline, our independence to thrive. For working class families such as my former neighbors from Jackson Street, they continue to struggle to survive in San Francisco. San Francisco is our home.”

 

Enacted as state law in 1985, the Ellis Act allows owners to evict tenants and quickly turn buildings into Tenancy In Common (TIC) units for resale on the market. In San Francisco, the units that are being cleared are often rent controlled and home to seniors, disabled Californians and working class families. When these affordable rental units are removed from the market, they never return.

 

Senate Bill 1439 will be heard in Senate policy committees this spring.

Activists, union challenge Google bus pilot program

San Francisco activists and labor filed an appeal of the controversial commuter shuttle (aka, the Google buses) pilot program to the Board of Supervisors today, alleging it was pushed through without a proper environmental review. 

The appeal was filed by a coalition of the Harvey Milk LGBT Democratic Club, SEIU 1021, The League of Pissed Off Voters, and Sara Shortt of the Housing Rights Committee. 

The shuttles, mostly to Silicon Valley tech firms, pick up passengers in Muni bus stops. The use of public bus stops would incur a $271 fine for private autos, and often do, but the shuttles have largely received a free pass from the city. Last month, the San Francisco Municipal Transportation Agency approved of a pilot plan hatched behind closed doors that allows use of 200 bus stops by the private shuttles, charging only $1 per stop, per day.

The appeal alleges that the program needed review under the California Environmental Quality Act, which asks for projects to be analyzed for, among other things, land use, housing, and public health impacts. 

“CEQA actually identifies displacement as an environmental impact,” attorney Richard Drury, who filed the appeal on behalf of the coalition, told us. “Almost no one knows that. Honestly I didn’t know that, until I started researching all of this.”

If the Board of Supervisors doesn’t back the appeal, there may be a court battle on the environmental impact of the shuttle stops, which increase rents and home prices nearby. 

Paul Rose, spokeserpson for the SFMTA, responded to the complaint in an email to the Guardian.

“We developed this pilot proposal to help ensure the most efficient transportation network possible by reducing Muni delays and further reducing congestion on our roadways,” Rose wrote. “We are confident that the CEQA clearance is appropriate and will be upheld.”

In the meantime, Drury told us, the coalition is performing environmental research of its own. It has experts from the US Environmental Protection Agency and other organizations analyzing diesel outputs from the shuttles, as well as the impact of shuttles on displacement. 

“CEQA review needs to have a review before they start the pilot, not after,” Drury said. “They’re basically doing it backwards: let’s have 200 stops and 35,000 people in the service, and figure out what happens.”

Some studies conducted already show that affluence rises wherever the shuttle stops are placed. One by Chris Walker, a 29 year old in Mumbai, India, shows rising property values in and around the Google bus stops from 2011 to 2013.

“We see the Google Bus as a part of a larger effort to privatize public spaces and services, displacing both current residents and the public transportation system we rely on,” said Alysabeth Alexander, Vice President of SEIU Local 1021, in a statement. “San Francisco has a long history and tradition as a union town. With the tech takeover, San Francisco is becoming inhospitable to working class families. Our wages are stagnant, as the cost of everything is skyrocketing. This is a shame.”

Who influenced the Google-bus policy?

On SFBG.com last week, we published a list of the attendees (and corporate affiliations) who were recorded as having attended stakeholder meetings with the San Francisco Municipal Transportation Agency to discuss that private shuttle pilot program that caused such a dustup last month. The list is a matter of public record and was submitted to the Bay Guardian by a source who wished to remain anonymous.

Google was in the room, of course, but not all attendees were affiliated with corporate shuttle providers who bus employees to their workplaces. One company, called Leap Transit, has started a private luxury bus in San Francisco that is not affiliated with any particular employer.

“Our buses are clean and our staff is friendly,” according to Leap’s website. “Sip your morning coffee in peace.” (Leap did not respond to our request for an interview about its future plans.)

Another participant who seemed a bit far afield from the transportation sector was a representative from TMG Partners, a real-estate developer. Also included in the meeting was a representative from a law firm called Morrison Foerster which has represented major tech investors such as Kleiner Perkins, according to its website, which can be found at mofo.com.

How did these individuals manage to get invites? We emailed SFMTA spokesperson Paul Rose to ask that question. He told us, “When we started the work, we received a set of shuttle sector contacts from the [San Francisco County Transportation Authority], who started looking at this issue. One of the first things we did was reach out to these companies and confirm the right contact people. We also reached out to companies who we’d heard had shuttles.”

He added, “Over time, additional shuttle service providers and companies that offer shuttles for their employees contacted the agency to let us know that they were either providing service or considering to provide shuttle service and wanted to know about our policy development process. This also grew our list. And, as we heard about new shuttle programs, we reached out the companies to make contact. Also, at meetings with shuttle providers, we also asked if there were other providers we should include. Some members of the shuttle sector brought their legal or PR reps with them to the meetings — they were not on our list.”

Created by Bay Area technologists in partnership with the San Francisco Bay Guardian, BayLeaks uses the latest cryptography software to protect the identities of our sources. This is a secure, anonymous way for concerned citizens to communicate with journalists to release information.

“Politically, economically, and socially, it is becoming increasingly clear that the Bay Area is at a crossroads. We see BayLeaks as a critical first step in securing radical transparency in public discourse as the region charts its future,” said T.R. Hwang, a BayLeaks partner and deputy director of the San Francisco Committee of Vigilance, a citizens’ alliance dedicated to enhancing the public sphere through technology.

Our system uses SecureDrop, a whistleblowing platform managed by the Freedom of the Press Foundation, and Tor, an online anonymity network that has gained the trust of Internet users around the world.

The SecureDrop program originated with the late Aaron Swartz, who developed it in collaboration with Wired Editor Kevin Poulson. Swartz was an Internet activist and programmer known for hashing out inventive ways to fight corruption and promote transparency. He’s remembered, among other things, for cofounding Reddit, the online news site; and for founding Demand Progress, an online activism group known for its 2012 campaign against the Stop Online Piracy Act.

Now SecureDrop is managed by the Freedom of the Press Foundation, a nonprofit organization founded in 2012 that is “dedicated to helping support and defend public-interest journalism focused on exposing mismanagement, corruption, and law-breaking in government.”

To provide maximum security, BayLeaks is only accessible over the Tor anonymity network.

When connecting to Tor in order to submit documents through SecureDrop, the Freedom of the Press Foundation recommends first going to a public location, such as a library or a café, rather than using one’s home or work station where it would be easier for a third party to detect you as a Tor user.

The Tor Browser is as easy to use as other browsers. But once you have downloaded it, it masks the IP address of the computer you are working on by sending your requests through a set of computer relays to keep anyone from tracing communications back to you.

Using the Tor Browser allows you to access Tor Hidden Services like BayLeaks, which are only available over Tor and can be much more secure than ordinary websites. These hidden services have .onion Web addresses (the .com of the digital anonymity world). After you’ve submitted something to BayLeaks, journalists can use the SecureDrop system to communicate securely and anonymously with you. Once you’ve sent all documents to BayLeaks, the Freedom of the Press Foundation recommends deleting the Tor Browser Bundle, destroying any recorded copies of your codename (see “A Low Tech How-To”), and erasing or destroying any media (CD-ROMs, USB sticks) used to copy the leaked documents.

At one point protesting tech buses was new and shiny, but now it barely registers a shrug from San Franciscans. The newest eviction protest took a different turn.

On Saturday, protesters jumped up on stage to interrupt Googlers meditating at the annual Wisdom 2.0 conference. The Google corporateers sat on the stage, ready to share their secret to mindfulness “the Google way.” No one said “meditate on all the money you’re making,” but maybe it was implied. 

Meng Tan, who was identified on the Wisdom 2.0 website as “Google employee #107” (oh, inner circle!), is a corporate trainer who wrote the bestselling book Search Inside Yourself. He looked totally serene on stage, legs crossed. Next to him sat Bill Duane, a senior manager in charge of well-being, among other things. Hundreds were in the audience, watching. Duane began by trying to introduce Tan.

“I’ll start by introducing… not this person,” Duane said as the protesters unexpectedly strolled across the stage, carrying the now familiar banner championing an Eviction Free San Francisco, and the audience applauded.

“Wisdom means stop displacement, wisdom means stop surveillance, what do we want? Stop the evictions!” chanted Erin McElroy through a bullhorn, one of the lead organizers of the Anti-Eviction Mapping Project. She was at the forefront of the Google bus protests, as well as the TechCrunch protest, the Crappies.

The protesters were ushered off the stage, and security engaged in a tug of war with the protesters for their banner. 

The protest group, Heart of the City, noted in their press release that video from the protest was not available on the conference’s website (though the protesters had their own camera on hand). 

Was it intentional on Wisdom 2.0’s part to censor the protest?

“The only reason it’s not up is our AV guys cut the feed as soon as the protesters walked on stage,” Rita O’Connell, communications coordinator for Wisdom 2.0 told us. She said that other feeds were captured, and that it would be posted “as soon as humanly possible.”

“We are going to put it out,” she said. “We’re not intentionally trying to keep it from anyone’s view.”

We reached out to Google spokepeople, but our emails weren’t returned before press time. 

Many reading this no doubt will wonder about the point of interrupting a Google presentation  on meditation and spiritual well being to talk about evictions in San Francisco. What, if anything, do they have to do with one another?

The spiritual advocacy group The Bhuddist Peace Fellowship put it eloquently in its post “Why Google Protesters Were Right to Disrupt Wisdom 2.0”:

All the talk about kindness, happiness, and well being (with twin values of creativity, productivity, and profitability) focused on the users and innovators of technology. There was never any mention of the people who manufacture the gadgets that techies then outfit with meditation bell apps. What about the mindfulness, happiness, and well being of the people mining coltan in the DRC, or the people assembling iPhones at the infamous Foxconn sweatshops?

I mean, if we exclude them from the picture, then yes, we can calmly check in with our bodies. 

Things look very mindful and peaceful. Very reasonable, polite, and progressive.

But such deep exclusion invites deep delusion. Something important is missing. Entire groups of relevant people are cut out of the conversation altogether.

The fact is that waves of gentrification have pushed thousands of low-income, disproportionately (black and brown) residents out of San Francisco, and now the city is courting wealthy tech companies (like the ones at Wisdom 2.0) to move in.

Are we just going to ignore the people who are being displaced? Act like we don’t know about this history?

Are we going to pretend that there’s nothing we can do about it?

Hopefully, our friends with the banners won’t let us.”

After the protesters were ushered off the stage, the Google Senior Manager, Duane, then asked the audience to center themselves and consider their point of view. 

“Check in with your body and see what happens, and what it’s like to be around heartfelt people with ideas that may be different than what we’re thinking. Take a second and see what it’s like,” he instructed the audience. 

Meditating on other’s ills isn’t much, yet, but it’s a start. 

Update 2/19: The Wisdom 2.0 folks reached out to us to provide a correction, saying that the employee who engaged in a tug of war with the protesters for their banner was part of the Mariott A/V crew, and not security personnel. They also included this post on their blog:

We very much understand the concern about rent prices and evictions in San Francisco — we’re sure many Wisdom 2.0 conference attendees share the sentiment. There are many issues facing our culture that we try to address at Wisdom 2.0, and we freely admit that we do not always successfully cover every important topic that is worthy of public discussion. We do invite feedback about the topics we cover, and we also provide many opportunities for conference participants to engage in conversations with each other about topics that matter to them.  

In trying to communicate with the protesters after they left the stage, we were met with a great deal of aggression. The protesters chose to enter the conference using fabricated badges instead of reaching out to us to request that this conversation be included in conference programming. Rather than create more anger and division, we invite open dialogue in our community, and wish to support those who will engage with honesty and respect about the matters that are important to them.

That said: as part of Wisdom 2.0’s commitment to holding productive and inclusive conversations, we are currently designing a meetup that will focus on the creation and support of constructive dialogue around pressing social concerns like this one. Despite the rain on Feb. 8, organizers of a citywide tenants’ convention at San Francisco’s Tenderloin Elementary School wound up having to turn people away at the door. The meeting was filled to capacity, even though it had been moved at the last minute to accommodate a larger crowd than initially anticipated.

“Oh. My. God. Look at how many of you there are!” organizer Sara Shortt, executive director of the Housing Rights Committee, called out as she greeted the hundreds in attendance. “Tenants in San Francisco, presente!”

The multiracial crowd was representative of neighborhoods from across the city, from elderly folks with canes to parents with small children in tow. Translators had been brought in to accommodate Chinese and Spanish-speaking participants.

Six members of the San Francisco Board of Supervisors also made an appearance: Sups. John Avalos, David Campos, Eric Mar, Malia Cohen, Jane Kim, and Board President David Chiu.

In recent weeks, the convention organizers had convened a series of smaller neighborhood gatherings to solicit ideas for new policy measures to stem the tide of evictions and displacement, a problem that has steadily risen to the level of the defining issue of our times in San Francisco.

While several legislative proposals are on track to move forward at the Board of Supervisors, the meetings were called to directly involve impacted communities and give them an opportunity to shape the legislative agenda on their own terms, according to various organizers.

Addressing the crowd, Shortt recalled what she termed “some amazing jiu jitsu” during last year’s tenant campaigns, which resulted in a 10-year moratorium on condo conversions rather than simply allowing a mass bypass of the condo lottery, as originally proposed.

That measure, which won approval at the Board of Supervisors last June, was designed to discourage real estate speculators from evicting tenants to convert buildings to tenancies-in-common, a shared housing arrangement that’s often a precursor to converting rent-controlled apartments into condos.

That effort brought together the founding members of the Anti Displacement Coalition, and momentum has been building ever since. “This is the beginning of a movement today,” Gen Fujioka of the Chinatown Community Development Center, one of the key organizations involved, told the gathering. “We are shaking things up in our city.”

 

MAINTAINING DIVERSITY

Around 160 participants attended the first in a series of neighborhood tenant conventions in the Castro on Jan. 10. The one in the Richmond a week later drew so many participants that organizers had to turn people away to appease the fire marshal.

“The idea of the neighborhood conventions was to solicit ideas,” explained Ted Gullicksen, head of the San Francisco Tenants Union. “The idea of this event is to review existing ideas and ultimately rank them.” From there, the campaign will pursue a ballot initiative or legislative approval at the Board of Supervisors.

But first, a few speakers shared their stories. Gum Gee Lee spoke about being evicted from her Chinatown apartment last year along with her husband and disabled adult daughter, an event that touched off a media frenzy about the affordable housing crisis taking root in San Francisco.

“There were times that were very stressful for me. I would call places only for the owner to say, ‘I’ll get back to you,’ but they never did,” she said of that ordeal.

“To see everyone here, all kinds of people, it makes me really happy,” she later told the Bay Guardian through a translator. “I just hope they don’t get evicted.”

Mike Casey, president of UNITE-HERE Local 2 and an executive committee member of the San Francisco Labor Council, also made a few comments at the forum.

“Having the ability to live and vote in this city makes a difference,” he pointed out, saying workers who have to commute long distances for political actions because they’ve been displaced from San Francisco are less likely to get involved.

“The struggle of our time is the widening gap between the rich and the poor,” Casey added. “That is exactly what this struggle is about: to maintain that diversity. What we need to move forward on is bold, effective, measurable change that makes sure we are able to protect the fabric of this community.”

Maria Zamudio, an organizer with Causa Justa/Just Cause, emphasized the idea that the problem of evictions in San Francisco is less of a market-based problem and more of a threat to the city’s existing, interwoven communities.

“Those are our neighborhoods and our communities,” Zamudio said. “We’re fighting for the heart of San Francisco. Fighting for strong tenant protections is a necessary struggle if we are going to keep working class San Franciscans in their homes.”

 

ELLIS ACT UNDER FIRE

As Gullicksen noted at the start of the convention, San Francisco rents have ballooned in recent years, rising 72 percent since 2011.

“We are seeing the most evictions we have seen in a long, long, long, long time,” Gullicksen said. “Most Ellis evictions are being done by one of 12 real estate speculators — evicting us and selling our apartments, mostly to the tech workers.”

Even though median market-rate rents now hover at around $3,400 per month in San Francisco, low-income tenants can avoid being frozen out by sudden rental spikes because rent-control laws limit the amount rents may be increased annually.

But that protection only applies to a finite number of rental units, those built before 1979. That’s why tenant advocates speak of the city’s “rent-controlled housing stock” as a precious resource in decline. Long-term tenants with rent control — in the worst cases, elderly or disabled residents who might be homeless if not for the low rent — are often the ones on the receiving end of eviction notices.

From 2012 to 2013, according to data compiled by the Anti Eviction Mapping Project, the use of the Ellis Act increased 175 percent in comparison with the previous year. That law allows landlords to evict tenants even if they’ve never violated lease terms. Advocates say real estate speculators frequently abuse Ellis by buying up properties and immediately clearing all tenants.

Concurrently with local efforts agitating for new renter protections, organizers from throughout California are pushing to reform the Ellis Act in Sacramento.

Assemblymember Tom Ammiano has promised to introduce a proposal by the Feb. 21 deadline for submitting new legislation, and Sen. Mark Leno is working in tandem with San Francisco Mayor Ed Lee on a parallel track to pursue some legislative tweaks aimed at softening the blow from the Ellis Act.

“Our goal is to change the conversation in Sacramento, where tenants’ concerns are routinely ignored,” said Dean Preston, director of Tenants Together, a statewide organization based in San Francisco.

On Feb. 18, busloads of protesters will caravan to Sacramento from San Francisco, Oakland, and Fresno for a rally. Preston said they’ve got three demands: reform the Ellis Act, restore a $191 million fund that provides financial assistance for low-income and senior renters, and pass Senate Bill 391, which would provide new funding for the construction of affordable housing.

Even though the law is technically intended to allow property owners to “go out of the business” of being a landlord, Ellis Act evictions in San Francisco are most often carried out by speculators who purchase real estate already occupied by tenants, Gullicksen said.

“Our focus is on the most immediate problem, which is the misuse of the Ellis Act by real estate speculators,” Preston said. “It’s urgent to address that specific use. That’s what Ammiano and Leno are looking at, is ‘what’s the best way to stop speculative use?'”

 

LOCAL POLICY CHANGES SOUGHT

Tyler McMillan of the Eviction Defense Collaborative said his group is often the last resort for tenants threatened with the loss of their rental units. “Too often, we face a losing fight at court,” he said. “We need to write better laws that work better to keep people in their homes.”

The legislative proposals moving forward at the local level seek to attack the problem of evictions and displacement from several angles. On Feb. 3, Sup. David Campos introduced legislation to require landlords who invoke the Ellis Act to pay a higher relocation fee to displaced tenants, equaling two years’ worth of the difference between the tenants’ rent and what would have been considered market rate for that same unit.

“It is time that we recognize that tenants must receive assistance that is commensurate with market increases in rent if we are to truly address our affordability crisis and check the rampant growth of Ellis Act evictions,” Campos said.

As things stand, relocation assistance payments are around $5,261 per tenant, and are capped at $15,783 per unit, with higher payments required for elderly or disabled tenants. But at current market rates, a tenant would not last more than a few months in the city relying solely on the relocation fee to cover rental payments.

Surveying the strong turnout at the tenant convention, Campos said, “There is a movement that’s happening in San Francisco to take our city back, and to make it affordable for all of us.” Yet he noted that he is concerned there will be major pushback from the San Francisco Apartment Association and the real estate industry, formidable interests that oppose the relocation fee increase.

Meanwhile, Sup. Mar has proposed an ordinance that would require the city to track the conversion of rental units to tenancies-in-common, a housing arrangement where multiple parties own shares of a building through a common mortgage. Speculators who buy up properties and immediately evict under the Ellis Act often angle for windfall profits by immediately converting those units to TICs.

Campos is also working on legislation that would regulate landlords’ practice of offering tenants a buyout in lieu of an eviction, a trend advocates say has resulted in far greater displacement than Ellis Act evictions without the same kind of public transparency.

Peter Cohen of the Council on Community Housing Organizations said there’s “no silver bullet” to remedy San Francisco’s affordable housing crisis. “This process is going to come up with another bundle of things,” he said. “All of that is also complimentary to the state campaign. You could have five, six, or seven policy measures going forward — and all of them winnable.”

An idea Cohen said has received traction is the idea of imposing an anti-speculation tax to discourage real estate brokers who abuse the Ellis Act by buying up properties and evicting all tenants soon thereafter (see “Seeking solutions,” for details).

During a breakout session at the tenant convention, longtime LGBT activist Cleve Jones piped up to say, “Harvey Milk proposed the anti-speculation tax back in 1979.”

It wasn’t successful at that time, but Cohen said that given the current level of concern about housing in San Francisco, it’s being talked about in some circles as the most winnable ballot initiative idea.

 

TENANTS FIGHTING BACK

At the Feb. 8 convention, tenants shared stories of challenging orders to vacate their rental properties. “The most important thing that has brought us to the victories we’ve had so far is that tenants have stayed in their homes,” Shortt said. “Tenants have fought, tenants have sought help, tenants have organized.”

Tenants from a North Beach building owned by real estate broker Urban Green shared their story of banding together and successfully challenging an Ellis Act eviction. Chandra Redack, a nine-year resident of 1049 Market St., where tenants continue battling with owners who submitted eviction notices last fall, described to the Bay Guardian how her small group of tenants has continued to organize in the face of ongoing pressure, including the owners’ recent refusal to accept rent checks.

“Our organizations only can support tenants when they stand up and fight,” said Fujioka. “The tenants’ resistance themselves is part of the strategy. If we don’t have rights, we are going to create them.”

Paula Tejeda, a longtime resident of the Mission District originally from Chile, told the Bay Guardian that she’d been threatened with an eviction from her home of 17 years, a Victorian flat on San Carlos Street.

“I thought I was dealing with an Ellis Act, now he’s trying his best for a buyout,” she explained.

Living in that rent-controlled unit made it financially feasible for her to contribute to the Mission community as a small business owner, as well as a poet, author, and active member of the arts community, she said. Tejeda is the proprietor of Chile Lindo, an empanada shop at 16th and Van Ness streets.

“Having the rent control made it possible for me to build Chile Lindo, go back to college and get my MBA,” she said. That in turn gave her the resources to employ one full-time and three part-time staff members, she said.

When she was initially faced with the prospect of moving out, “I wanted to shut down and leave, and go back to Chile,” she said. “We are suffocated, as a society that cares only about the bottom line.”

But surveying the hordes of tenants milling about at the convention, she seemed a bit more optimistic. “The fact that this is happening to everyone at the same time,” she reflected, “is kind of like a mixed blessing.”

Seeking solutions

A number of policy ideas emerged from the neighborhood tenant conventions, which were held by the San Francisco Anti Displacement Coalition in the Mission, Chinatown, Haight/Richmond, Castro, SoMa, and the Tenderloin.

Here’s a list of what tenants came up with at those forums, which attendees ranked in ballots collected at the event. The ideas will most likely result in a November ballot initiative and one or more legislative proposals, which organizers plan to announce in the near future.

Anti-speculation tax: One idea is to impose a tax on windfall profits garnered by speculators who buy up housing and then sell it off without maintaining ownership for at least six years. The tax would be structured in such a way that the quicker the “flip,” the higher the tax. This would require voter approval.

Eviction moratorium: This proposal is to put a yearlong freeze on certain kinds of “no-fault evictions,” instances where a tenant is ousted regardless of compliance with lease terms. State law would prohibit it from applying to Ellis Act evictions. It might potentially require voter approval.

Department of Rent Control Enforcement and Compliance: This new department, which could be done by local legislation, would create a new city department with the mission and mandate to enforce existing tenant-protection laws and conduct research on eviction trends.

Relocation assistance: While Sup. David Campos is working on legislation to upgrade relocation assistance payments to displaced tenants who face eviction under the Ellis Act, this proposal would do the same for all other forms of “no-fault” evictions. This would require voter approval.

“Excessive rents” tax: While the Costa-Hawkins state law does not allow for cities to control rents in vacant units, this proposal would create a tax on new rental agreements where rents exceed an affordability threshold.

Housing balance requirement: This proposal would make it so that approval of new market-rate housing would be restricted based on whether affordable housing goals were being met. It would create new incentives to build affordable.

Legalize illegal units: This would provide a way to legalize the city’s “illegal” housing units that nevertheless provide a safe and decent source of affordable housing. (Board President David Chiu has already introduced a version of this proposal.)

When Mikhail Baryshnikov’s Hells Kitchen Dance troupe performed at the Zellerbach Play House in 2006, he looked fabulous — at 58, a self-effacing, masterful dancer. He also brought works by two barely known choreographers. Benjamin Millepied, at the time a dancer with New York City Ballet, now runs the Paris Opera Ballet; the Canadian Aszure Barton’s two pieces immediately marked her as someone with chops to burn and a fascinating individual voice. She hasn’t stopped working — all over the world. Now SF Performances is bringing her back with Awáa, a piece inspired by an underwater dream, in which Barton, apparently, explores the masculine and feminine traits we all have. This trio’s debut S/T album was essentially a collection of undeniable indie-pop hooks matched by songwriting that combined Belle and Sebastian’s wittiness with the urban social unease of a Shirley Jackson story. Still it didn’t quite capture the appeal as a live band, where I found them to be most endearing. On its freshly minted second album, Trouble, Hospitality has set out to prove their mettle as simply a rock (drop the indie, drop the twee) group as well. While Amber Papini’s voice is still endlessly charming — listen to the way her double esses fill in some hissing hi-hat on The Who-styled percussion on “I Miss Your Bones” — but the band seems in less of a hurry, giving the guitar and bass its due. DANCE For its 10th anniversary, the Black Choreographers Festival: Here & Now won’t start with its customary lineup of performances, but with a ritual so ingrained that many dancers continue it even after they have retired from the stage. Dancers are obsessed with taking classes. Classes are why they scrape money together. If you’re part of a company, classes are a part of your daily routine. If you aren’t, you’re on your own — and at around $10 or $15 a session, that can quickly add up to a serious amount of cash.

So how about 10 cents a class? At this year’s BCF, you can pay 50 cents for an all-day pass, good for up to five classes at Yerba Buena Center for the Arts’ Forum, taught by Robert Moses, Nora Chipaumire, Marc Bamuthi Joseph, and Rashad Pridgen. A showcase by the next generation of dancers — Dimensions Extensions Performance Ensemble, Destiny Arts, and the Village Dancers — is included in this bargain price.

BCF arose from the ashes of the renowned but collapsing festival known as Black Choreographers Moving Toward the 21st Century. At the festival’s final concert in 1995, financial constraints prevented it from inviting out-of-town artists, so it was an all-Bay Area show. That’s where the seed for BCF was planted. Laura Elaine Ellis, who had just started to choreograph, danced that night.

“I was so honored to be included,” she recalls. “After the performance, all of us realized that this was the first time ever that we all had shared a stage together. It felt so good.”

Kendra Barnes didn’t perform that evening — she was still a San Francisco State student — but “I had attended every concert, and I had just started my own company.” The two women realized that they, and many of their colleagues, would have to self-produce. The African and African American Performing Arts Coalition was a first, short-lived attempt.

But it was when Ellis and Barnes had one of those “what if we…” moments that BCF was born. “We wanted to create a community where we could come together and see each others’ work,” Barnes says.

From the beginning BCF turned a wide-angle lens on African American choreography. It aimed to showcase the whole range of ages and experiences, with beginning and experienced choreographers, plus youth dancers. The emphasis has always been on the “here and now” of its name, although that doesn’t mean, Ellis explains, “that folks who are rooted in traditional forms and rethink them are excluded.” The festival developed a format of showing one weekend in the East Bay (at Laney College) and in San Francisco (at Dance Mission Theater) with both established artists and what the BCF calls “Next Wave Choreographers.”

A lesser-known yet important part of the festival offers training opportunities for a handful of pre- and post-college students who are interested in theater management, tech, and other backstage responsibilities. Several of them, says Ellis, have been able to enter those fields professionally after completing the program.

For this anniversary season, BCF created its most ambitious schedule yet: four weekends of performances by an impressively diverse group of African American dance artists. A partnership with YBCA enabled the organizers to bring Zimbabwe-born Nora Chipaumire for the Bay Area premiere (Feb. 13-15 at YBCA) of Miriam, a work inspired by singer Miriam Makeba and the Virgin Mary, among others. “Nora has gone on to an international career, yet she started in the Bay Area,” Ellis points out.

On the penultimate weekend (Feb. 28-March 1 at Laney College), former Lines Ballet dancer-choreographer Gregory Dawson has created birdseye view, a sextet set to an original jazz score performed live by the Richard Howell Quintet. Zaccho Dance Theatre will present the Oakland premiere of Joanna Haigood’s haunting Dying While Black and Brown; it looks at the effect of incarceration on the human spirit. Joining the lineup will be a work in progress by Barnes (Feb. 28 only), Haitian Dancer Portsha Jefferson, and spoken-word artist Joseph.

Financial constraints prevented the programming of an accompanying film component this year, though the bitter pill was sweetened by a last-minute arrival: UPAJ, Hoku Uchiyama’s film about the partnership between Kathak artist Chitresh Das and tap dancer Jason Samuels Smith, will screen Feb. 28 at 6:30pm before that evening’s performance.

Looking back, Ellis figures that over the last decade they have presented almost 80 choreographers. So for this year’s special “Next Wave” program (Feb. 21-23 at Dance Mission), they sent out a call to “alumni.” It’s a homecoming for the 21 artists who accepted, and it should be heady mix, running (alphabetically) from Ramón Ramos Alayo to Jamie Wright.

For the ODC Theater finale (March 6-8), Robert Moses has curated an intriguing and somewhat mysterious evening, which includes a premiere of his own, Bliss Kohlmeyer and Dawson choreographing on his company, and Moses acting as a “host” to various choreographers. So far Raissa Simpson, Byb Chanel Bibene, and Antoine Hunter are confirmed, with more to come. *

EDITORIAL Humans tend to believe that we’re smarter than we really are. It’s a problem that can be exacerbated by concentrations of wealth and technological expertise, which can cause some people to believe they have an almost God-like power to manifest solutions to any challenge they confront, particularly when they have lots of money to throw at the problem.

But that’s really just hubris. It’s the story of Icarus striving for the sun and falling back to Earth when his technology failed him. Knowing our limits and feeling a sense of humility and social responsibility are the first steps toward dealing honestly with problems we face. And last week, we were reminded again of this reality by venture capitalist Ron Conway, the libertarian-leaning power broker who has taken a paternalistic hold on the city (see “The Plutocrat,” 11/27/12).

Being a newspaper that has always believed in gun control, we share Conway’s newfound desire to reduce gun violence, a cause he suddenly adopted after the massacre at Sandy Hook Elementary school in December 2012. Conway and his Smart Tech Foundation last week unveiled some early designs for high-tech guns that only work in the hands of their owners, and which will notify those owners when someone has moved them.

“Let’s use innovation to bring about gun safety. Let’s not rely on Washington,” Conway told the San Francisco Examiner, which put the story on its Jan. 29 cover.

There are many levels of ridiculousness to Conway’s belief that his gizmos can do more to reduce gun violence than even modest federal regulation of the more than 300 million guns in this country. After all, guns are designed to inflict violence, and just 3 percent of gun deaths are accidental shootings (62 percent are suicides and 35 percent are homicides). Sandy Hook shooter Adam Lanza used guns from his home that he’d been taught to use by his mother, who ended up being his first victim, so it seems unlikely Conway’s guns would have changed that outcome.

When reporter Jonah Owen Lamb asked Conway how his technology differed from widely available trigger locks, he compared them to the iPhone, which invented a new market for its product. So the answer to gun violence is creating a new market for a new generation of guns that only their wealthy owners can fire?

While we’re not huge fans of the Second Amendment — the one that conservatives like Conway consider sacrosanct — we do understand that it was written to give the masses tools to resist wealthy and powerful oppressors. That includes people like Conway, fellow venture capitalist Thomas Perkins (whose comparison of progressive activists to Nazis has been lighting the Internet), and the Establishment politicians whom they sponsor.

Guys, society doesn’t need your gizmos, libertarian ideals, or hubris to address the most vexing challenges we face, from gun violence to global warming to creating a modern transportation infrastructure. We just need some of the obscene wealth you’ve been hoarding.

 

Did Feinstein see a drone?

For years now, Bay Area organizers with the antiwar group Code Pink have been staging protests outside the Pacific Heights residence of Sen. Dianne Feinstein, who chairs the Senate Intelligence Committee.

Code Pink director Medea Benjamin has led delegations to Pakistan and Yemen in the past to protest US drone strikes, and San Francisco activists have frequently appeared outside the senator’s home to sound off against the US military’s use of drones.

But more recently, Code Pink activists have paid visits to Feinstein to let her know what they think of her comments condemning the actions of whistleblower Edward Snowden.

“We at Code Pink think Edward Snowden did a great service to this country,” by leaking secret National Security Agency documents detailing the intelligence agency’s dragnet surveillance program, said organizer Nancy Mancias.

So on June 15, 2013, “We flew a couple toy helicopters outside her home” as part of an anti-surveillance protest. It was an “Austin Powers” themed protest, she added, “playing spy-type music.”

But a couple months ago, Feinstein mentioned during a hearing about drones that she’d actually seen a drone peeking outside her window at her San Francisco home. She said it crashed shortly after she detected it.

But that left activists and others wondering about Feinstein’s account, since Mancias says the remote controlled device they sent up to fly around Feinstein’s mansion was not a drone, but rather a pink helicopter, “like a toy you pick up at Toys-R-Us.”

The Code Pink activists captured video of the event, she added, and sent it to the television program 60 Minutes. “Hopefully, they’ll air it when they interview Dianne Feinstein.”

Another wrinkle in Feinstein’s story is that “she said she was home when this demonstration was happening,” Mancias said. “But we were knocking on the door, ringing the doorbell.”

Believe it or not, Feinstein has actually responded to this sort of activity in the past by coming to the door and engaging with the concerned, pink-clad citizens.

“She’s a very old school politician,” Mancias said by way of explanation. “She’s very approachable. On that day she didn’t come outside, and if she was home, we would have loved to have a discussion with her about Edward Snowden.”

So was Feinstein’s account of spotting a surveillance drone rooted in nothing more than noticing a pink kid’s toy zip past her window during a routine Code Pink protest?

Nobody knows for sure but nevertheless, Code Pink activists feel vindicated. “I can say that we actually achieved our goal,” Mancias said. That’s because more recently, Feinstein has softened her stance somewhat and admitted that “we need to look into” the domestic surveillance program.

But that perception of a small victory doesn’t mean they aren’t going back. On Tuesday, Feb. 11, Code Pink plans to return to Feinstein’s Pac Heights mansion for yet another protest, this time to coincide with a national day of action being planned in opposition to NSA spying.

Called “The Day We Fight Back,” the Feb. 11 action day will consist of website owners installing banners to encourage their visitors to challenge online spying, and employees of tech companies calling on their organizations to do the same.

“We’re asking people to bring surveillance equipment, drones, and magnifying glasses,” to Feinstein’s house, Mancias said, presumably talking about props and not real surveillance equipment (does Google Glass count?). “We’ll just play some music,” she added, “and have a fabulous time.”

Evictions and displacement have become San Francisco’s top political issues, amplified by protests against tech companies that are helping gentrify the city. Yet Airbnb, which facilitates the conversion of hundreds of San Francisco apartments into de facto hotel rooms, has so far avoided that populist wrath.

Tenants use the online, short-term rentals to help make rent in this increasingly expensive city, a point that the company often emphasizes.

“For thousands of families, Airbnb makes San Francisco more affordable,” Airbnb spokesperson Nick Papas wrote to the Guardian by email, citing a company survey finding that “56 percent of hosts use their Airbnb income to help pay their mortgage or rent.”

But it’s also true that Airbnb allows hundreds of rent-controlled apartments to be removed from the permanent housing market — in violation of local tenant, zoning, tax, and other laws — something that has united tenant, landlord, hotel, and labor groups against it (see “Into thin air,” 8/6/13).

“The problem is Airbnb is so easy and attractive that you can take a unit out from under rent control forever,” San Francisco tenant attorney Joseph Tobener told the Guardian.

“We’re getting 15 calls a week on Airbnb,” he said, describing four categories of complaints: landlords evicting tenants to increase rents through Airbnb, tenants complaining about neighbors using Airbnb, tenants being evicted for getting caught illegally subletting through Airbnb, and Airbnb hosts who can’t get guests to leave (city law gives even short-term residents full tenant rights, except in hotels).

There isn’t good public data on how many units are being taken off the market, but Airbnb generally lists well over 1,000 housing units in San Francisco at any given time, with its smaller competitors (such as Roomorama and VRBO) adding hundreds more.

The San Francisco Rent Board listed 326 no-fault evictions (Ellis Act, owner move-in, capital improvement) in its 2012-13 annual report. That number is almost certain to rise in the 2013-14 report due out in March, and it is compounded by an unknown number of buyouts that pressure tenants to voluntarily leave, all of it creating a displacement crisis that has galvanized the city.

“Isn’t it far more likely that more units are being lost [from the rental market] through Airbnb?” San Francisco Magazine recently quoted a UC Berkeley professor as saying in an article questioning whether Ellis Act evictions are really a “crisis.”

So Airbnb is clearly having a big impact on the city’s affordable housing crisis. Yet Airbnb is largely flying under the political radar in its hometown and ducking questions about its impacts.

“Airbnb has all the statistics we need to assess its impacts on the city’s housing market,” Tobener said. The company refuses to disclose such data. Airbnb’s customers need to consider their impacts to the city’s affordable housing crisis, Tobener added, because “there are social consequences to the decisions we make.”

 

STALLED IN LIMBO

Last year I discovered Airbnb was flouting a ruling that it should be paying the city’s 15 percent transient occupancy tax (“Airbnb isn’t sharing,” 3/19/13), a nearly $2 million per year tax dodge.

Yet Airbnb, which has quickly grown from a small start-up into a company worth nearly $3 billion, has some powerful friends in Mayor Ed Lee and venture capitalist Ron Conway, who invests in both Airbnb and Mayor Lee’s political campaigns and committees.

So the company has stonewalled Guardian inquiries for the last year as it has worked with Board of Supervisors President David Chiu on legislation that tries to bring the company’s business model into compliance with local laws. That hasn’t been easy, as Chiu told us.

“It has been difficult to corral the different stakeholders to get on the same page,” Chiu said. “Airbnb has been like unraveling an onion. The more progress we make, the more issues come up.”

Janan New, executive director of the San Francisco Apartment Association, says it shouldn’t be so hard. “They need to enforce the law. They need to collect the hotel tax. They don’t need new laws,” she told us.

While the city is unlikely to simply follow New’s advice, the displacement issue adds another layer to Airbnb’s onion, one that sources say has become an issue of growing concern within the company, which has finally begun to respond to Guardian inquiries.

Those concerns have also been compounded as Airbnb is now being sued by one of Tobener’s clients, Chris Butler, who says he was evicted from his rent-controlled Russian Hill apartment so the landlord could make more money through Airbnb (see “Airbnb profits prompted SF eviction, ex-tenant says,” SF Chronicle, 1/22/14).

“We strongly support rules that keep people in their homes, and the vast majority of Airbnb hosts are regular people just trying to make ends meet,” Airbnb told the Guardian. “Whatever happened in this case, we certainly do not support unscrupulous landlords who evict long term tenants solely to turn their apartments into short-term rentals, but it is important to note that experts have found such cases to be extremely rare.”

Airbnb didn’t respond to our follow-up questions, but those “expert” findings appear to be a reference to a study the company commissioned late last year from Berkeley-based Rosen Consulting Group entitled “Short-Term Rentals and Impact on Apartment Market.”

But that study of Airbnb’s impact to rental housing in San Francisco doesn’t really draw the conclusions that company seems to think and hope it does.

 

MISLEADING NUMBERS

One number that the study and Airbnb have repeatedly sought to highlight is the claim that “90 percent of Airbnb hosts in San Francisco use Airbnb to occasionally rent out only the home in which they live,” as the company put it to us.

“Airbnb users generally do not identify themselves as utilizing short-term rentals as a business. In fact, 90 percent of Airbnb hosts [in San Francisco] indicated that they live in the home listed on Airbnb,” was how the study put it.

“It’s trash. They pick and choose the data they want to share,” Tobener said of the study and the 90 percent figure, which he says was derived from a 2011 user survey before the local housing market exploded. Rosner Consulting told us it stands by the study but won’t discuss it.

The figure also lumped in those with multiple rooms in their homes that have traditionally been rented by local residents and covered by rent-control laws. It also discloses that 10 percent of Airbnb hosts are renting out outside units simply as a business, a figure that has likely risen over the last three years.

The study does disclose that there were 1,576 properties booked through the company in August 2012, which the study notes was just 0.4 percent of the 378,000 homes in San Francisco, which Airbnb uses to dismiss its impacts on the market.

But the study includes only macroeconomic data, rather than looking at the company’s impact on certain socioeconomic groups — such as those making 120 percent or less of median area income, the people being evicted from and priced out of the city — or the supply of rent-controlled housing.

“The average gross income per Airbnb property in the previous 12 months was $6,722, or an average of $564 per month,” the study discloses, choosing to use average rather than median figures even though they’re considered less accurate gauges of income and housing data.

Customers who only use Airbnb once or twice will skew those averages way down. Yet the study then compares that number to the “average market-rate apartment rent in San Francisco, which was $2,498 per month in mid-2013. The average income generated is insufficient to cover monthly rental expenses in full.”

Which tells us nothing about how Airbnb is impacting either rent-controlled housing or the median income San Franciscans who rely on it. According to the US Census Bureau, the median rent in San Francisco was $1,463 in 2012 and 64 percent of San Franciscans rent their homes.

“The study is bullshit,” Tobener said. “They could pull data and tell us how many people are renting full units on Airbnb, but they don’t.”

Yet the company claims that it is concerned about these issues and working with the city.

“We believe our community of hosts should pay applicable taxes and we are eager to discuss how this might be made possible. We’ve reached out to officials in San Francisco and we continue to have productive discussions with city leaders,” Airbnb told the Guardian. “These issues aren’t always easy, but if we work together, we can craft fair, responsible, clear rules that ensure San Francisco continues to benefit from home-sharing.”

Yet neither Airbnb nor its political supporters seem to want to have this public discussion. The company has stopped responding to our inquiries, again, and when we asked the Mayor’s Office about Airbnb’s impacts to the affordable housing market, we got this response and a refusal to directly answer either the original or follow-up questions: “The Mayor has prioritized preserving, stabilizing and growing the City’s housing stock. His policy priorities include protecting residents from eviction and displacement, including Ellis Act reform and stabilizing and protecting at-risk rent-controlled units, through rehabilitation loans and a new program to permanently stabilize rent conditions in at-risk units.”

Yet Airbnb continues to have an impact on those “at-risk rent-controlled units” that few people seem to want to discuss.

Presidio Trust decides on museum proposals

The Presidio museum showdown has come to an end for now, and the winner of the hotly contested mid-Crissy Field site is (drum roll, please) … no one.

Not the Golden Gate National National Park Conservancy. Not the Bridge Institute. And no, not Star Wars creator George Lucas.

At an impromptu press conference this afternoon, Presidio Trust Chair Nancy Hellman Bechtle said the board unanimously voted to not move forward with any of the museum proposals.

“This is the most spectacular site in the country,” Bechtle told reporters. “We simply do not believe any of the projects were right for this location.”

Since November of 2012, The Bridge Institute, the Golden Gate National Parks Conservancy’s Presidio Exchange, and filmmaker and Star Wars creator George Lucas’ personal pop art collection have all competed for a patch of uber-desirable real estate a stone’s throw from the Golden Gate Bridge.

The site is currently occupied by Sports Basement, whose planned move will be unaffected by the decision to reject the museum proposals, a spokesperson for the Presidio told the Guardian.

In January the three teams were made to re-submit their three proposals to the Presidio Trust, which cited Goldilocks reasons for not liking the various proposals. The Lucas Cultural Arts Museum was too big, the Presidio Exchange was too programmatically vague, and the Bridge Institute didn’t have enough of the green stuff (money).

But unlike Goldilocks, in the end the Presidio Trust did not find any porridge that was just right. However, it did offer to assist with finding alternative sites in the Presidio for the museums to find homes.

“There are a number of sites in the Presidio that are possible places to build,” said Presidio Trust Executive Director Craig Middleton. “We are really early in these conversations.”

The Lucas Cultural Arts Museum’s spokesperson, David Perry, said there are many cities vying for Lucas’ pop and cultural art museum.

“We’ve been getting requests to look at other sites for this museum, we’re going to look at those sites,” Perry said. We asked if he was referring to Chicago, where Lucas has expressed interest in building the museum before.

“I’ve heard all kinds of cities,” Perry said.

When we asked Perry how Lucas felt when he heard the news, he answered a bit oddly, if candidly.

“I spoke with George this morning,” he said.  “And as my grandmother used to say, if ‘ifs’ and ‘buts’ were candies and nuts, we’d all have a Merry Christmas.”

Okay then.

Notably, the Lucas proposal was endorsed by Mayor Ed Lee, tech venture captalist Ron Conway, and a host of other well-heeled and monied backers. In a letter to the Trust, Congresswoman Nancy Pelosi publicly urged its members to hurry up on a decision, and to choose something that would bring in “a vibrant cross section of visitors to the Presidio, with particular attention to inner-city youth.”

We asked Becthle what influence, if any, opinions from powerful politicians had on the Trust’s ultimate decision.

“They’re very interested in California and the city,” she responded. “Sure I listen to [Sen. Dianne Feinstein], and to Nancy, but I think it was most important to do what was right with the park, and not to please one side or the other.”

Tee time: a peek inside Urban Putt, the Mission’s indoor mini-golf course

On the back wall of the main room of the old Victorian building at 1096 S. Van Ness is a sculpture of two creepy angels. One holds the other in its arms, their wings keeping them up. These angels are part of the original construction of the building, back when it functioned as a mortuary. Perhaps due to the haunting angels, perhaps due to the thought of a dead body storage center, the building has sat empty on the corner of South Van Ness and 22nd Streets for 15 years.

Today, the angels are still there and the building’s new owner has no intention of taking them down. “We will preserve as much as we can from this old look,” says Steve Fox, the man behind San Francisco’s first indoor mini-golf course, Urban Putt, set to open in April. The “high-concept” course will feature a restaurant with “eclectic California comfort cuisine” upstairs and two bars with a “creative bar program,” according to Urban Putt’s most recent press release. 

Urban Putt is not your traditional mini-golf course. The fantastical, technologically advanced, steampunk-y 14-hole course (four short of the customary 18 due to space constraints) will be composed of high-tech gadgets, countless buttons and nobs, and a few obligatory tongue-in-cheek twists (see: the “TransAmerica Windmill”) contained within its homages to San Francisco landmarks. 

A replica of the Painted Ladies shakes in a simulated earthquake at the first hole. At the “Musical” hole, the golf ball is catapulted toward the ceiling before bouncing delicately on drums and a cymbal. A two-hole underwater area pays homage to Jules Verne: an intricate submarine embellished with control panels and levers — although the 150 motion-sensor LED floorboards (imitating the lights of phytoplankton) are exceptionally post-Verne. Next to those wistful angels, the “Day of the Dead” hole honors the building’s previous tenants.

With a name like Urban Putt and its kitschy concept, it’s tempting to call out the spot as yet another example of gentrification in the Mission. Can’t you just see the hordes of trendy techies lining up to play putt-putt before hitting up the Make-Out Room on a Saturday night? (Because you know they will…)

Fox, a longtime mini-golf fanatic, was prepared for the criticism. “The very first note we got was like ‘the nerve of these people.’ It was written up on the Chron that we were doing this,” he says about the initial backlash. “We had signed the lease two days before.”

So Fox put up his phone number outside the building to encourage any and all complaints about Urban Putt. He also set out to connect with the neighborhood, reaching out to the community when he started hiring. “I think they realized that I had every intention of not being some sort of carpet bagger,” says Fox.

For Fox, Urban Putt is a longtime dream. A lousy golf player himself, the former editorial director of PCWorld and editor in chief of InfoWorld is an avid putt putt player. Since the 1990’s Fox and his wife have been hosting mini golf parties at their house. So what happens when you grow old and have a lot of money? Make your dream come true.

“My theory in all of this, having spent years and years running organizations — albeit editorial organizations, not mini golf — is if you don’t have expertise, go out and find the best people you can and have them do it,” says Fox. 

With experience that spans Burning Man, Maker Faire, the Exploratorium, and even MythBusters, the members of the design and construction team have an expansive background in creativity and innovation. “We have a group of people with real expertise in these areas. You can get that in San Francisco. There’s a lot of places you couldn’t find that. There’s that kind of wonderful talent base,” says Fox. At their disposal: the $17,000 3D printing ShopBot. Claiming it as one of their competitive advantages, Fox explains that the in-house printer will help his team can easily innovate, make changes, and repair the course over time.

Despite UrbanPutt’s extravagance, Fox maintains that the wonderland will be accessible to both children and adults, as well as both techy transplants and long-established local residents. His mission to keep games affordable ($8 for kids, $12 for adults) and to retain the vibrant local culture demonstrates his dedication to the city. Much of the building’s original construction will remain the same: the historical exterior, the metal front gate, the Victorian sconces, and the two angels at the back wall.

“People get that I am really of this neighborhood,” says Fox. “I think they’re responding well to that.”

Liberty Bradford Mitchell was a good kid growing up, and a pretty innocent one — probably more than you would expect given her proximity to the family business, the veritable empire of porn founded and run by her father and uncle, San Francisco legends Artie and Jim Mitchell. Now in her 40s and a mother of her own, Mitchell proves a likeably earthy presence if a less-then-compelling actor-playwright in her new one-woman show, directed by Michael T. Weiss, a firsthand account of growing up in San Francisco’s first family of raunch. Inseparable brothers Artie and Jim were the 1970s porn pioneers who founded the O’Farrell Theatre and road high in the industry, weathering court battles and substance abuse and divorce, but succumbing ultimately to their own lethal fallout — Jim Mitchell shot and killed Liberty’s father Artie in 1991. The material here is rich to say the least, and together with generous and explicit excerpts from archival footage and classic porn (including the Mitchells’ own era-defining Behind the Green Door, from 1972), it makes a fascinating bed for Liberty Mitchell’s reminiscences. Musical accompaniment by three-person SF band the Fluffers, meanwhile, punctuates the chronology with blasts of period rock, though often just a few bars worth, and backs up Liberty on the a single, rather awkward musical number. Moreover, despite the keen interest the basic historical facts and family anecdotes can generate, Mitchell’s filial narrative lens is only intermittently effective, being finally too pat, poorly drawn, and predictably sentimentalized to fully reverberate with the larger, almost archetypical or classical themes hovering nearby. Broken bodies, broken lives

Motorists driving for rideshare companies have struck and also killed pedestrians in San Francisco, even since state regulations were adopted to make these new transportation businesses safer and more accountable to the public.

Four months after the new rules were created, lawsuits from these incidents reveal that the new regulations contain gaping holes that continue to place passengers, pedestrians, and even drivers at risk.

One recent local story actually started in 2004 in Florida’s Monroe County. A vehicle sped down the Overseas highway at over 100mph. Ever seen the movie The Fast and the Furious? It was like that.

In the Florida heat, the car blazed by palm trees and an ocean view, hell bent for Miami. It accelerated as it took a curve, swerving around two vehicles going half its speed. Brazenly passing a traffic control device, the car cut off one more vehicle, then another, and another. Still barreling over 100mph, the driver swerved across the double yellow lines, forcing an oncoming vehicle to veer off the highway.

A traffic snarl put an end to the thrill ride. According to the Monroe County Sheriff’s Office incident report, which the Guardian obtained through a records request, driver Syed Muzzafar was accompanied by his wife and three children during his death-defying drive. He told the police officer, “This was just a dumb thing to do. I know I’m wrong.”

Muzzafar was booked for reckless driving. Nine years later, he would be booked again in San Francisco for hitting a family as they crossed the street in the Tenderloin.

On New Year’s Eve 2013, picking up fares for the tech company Uber, Muzzafar’s car struck young Sofia Liu, her mother, Huan Kuang, and brother, Anthony Liu. Six-year-old Sofia did not survive. Her family filed a wrongful death suit against Uber on Jan. 27, and will be represented by attorney Christopher Dolan.

Uber is part of an emerging cast of companies commonly known as rideshares, now legally called Transportation Network Companies (TNCs). The gist of how they operate is this: the company’s mobile app connects a driver with a customer, much like a taxi dispatch. Only a few years old, the TNCs initially operated in a wild west, devoid of regulation. But the California Public Utilities Commission passed rules for TNCs in September with the aim of protecting pedestrians, passengers, and drivers in collisions.

Uber, formed in 2009, has drivers in over 50 cities worldwide and an estimated worth of just over $3 billion, according to leaked evaluations. But Uber may still be in need of a version 2.0.

The death of the young Sofia Liu, killed by a driver already arrested for reckless driving, shows the state still has a long way to go on the road to regulating rideshares.

 

NOT MY PROBLEM

The night Muzzafar struck the Liu family, he was ferrying customers using the Uber app — but the company disavowed responsibility for the incident.

“We thank law enforcement for the quick release of information,” Uber wrote in a blog post the day after Sofia Liu died. “We can confirm that the driver in question was a partner of Uber and that we have deactivated his Uber account. The driver was not providing services on the Uber system during the time of the accident.”

But that’s a half-truth: Muzzafar was picking up passengers for Uber all night, but because he’d just dropped off a customer, he allegedly ceased being an Uber driver. With no passengers in the vehicle, Uber did not consider him “on the Uber system.”

If that sounds like a giant loophole, you’d be right — but it’s a legal one, for now.

The new CPUC regulations specify that TNCs must only provide liability insurance when drivers are “in service.” The Taxicab Paratransit Association of California is suing to modify those rules, saying the meaning of “in service” was never defined — and they allege this wording allows companies to disavow responsibility for a driver not carrying passengers at the moment of an accident.

This gaping loophole can also lead to insurance and liability consequences.

“I would guess that’s on the order of a $20 million liability case,” Christiane Hayashi, director of Taxi services at the San Francisco Municipal Transit Agency, said of Liu’s death. “The question is, who is going to pay for it?”

Muzzafar, and not Uber, may be on the fiscal hook, even though it’s unlikely he could cover the family’s medical and legal fees on his own.

Though much reporting has focused on TNC drivers’ lack of insurance, the collision that killed Sofia Liu on New Year’s Eve raises other questions as well. Just how did a driver with a reckless driving record manage to become a partner with Uber in the first place?

Checking out drivers

The recently drafted CPUC regulations require the TNCs to carry out background checks, a key element for safety. As it turns out, not all background checks are made equal.

Uber hired a private company called Hirease to conduct its checks, the Guardian learned in emails obtained from drivers. While Hirease requires Uber drivers to fill out a form with their personal information, taxi drivers who must register with the city’s transportation agency are screened with fingerprinting, Hayashi from the SFMTA told us.

The fingerprint checks make use of the FBI’s national criminal database, something a company like Hirease lacks access to (since it isn’t a government agency). We called the FBI’s background check department, based in West Virginia, to better understand the two methods.

We spoke to a rank and file employee, not a spokesperson, so he declined to give his name. The FBI employee spoke with a twang, and clearly laid out the problems.

The first snag with private background checks are false positives from common names (like John Smith) or stolen identities, he said.

Self-identification is also a problem. “If you’re a criminal, you’re not going to use your information,” the FBI employee said. “What if you were a lady and you were married six times, which name will you use for a background check? Bottom line, fingerprints are exclusive. Names are not.”

Another flaw is that while background checks performed for entities like the SFMTA make use of a federal database that dates back 100 years, California law doesn’t allow private background checks to go beyond seven years — and Muzzafar’s reckless driving arrest was nine years ago.

“Uber works with Hirease to conduct stringent background checks,” Uber spokesperson Andrew Noyes wrote to us via email. “This driver (Muzzafar) had a clean background check when he became an Uber partner.”

Hirease and Uber did what they legally could, but the summation of laws and regulations blinded Uber to Muzzafar’s background — and nothing in the new CPUC regulations would have prevented this. That may go a long way toward explaining how a man caught recklessly driving with his own family in the car in Florida was driving for Uber the night he allegedly struck and killed a child.

Importantly, California law does allow for a taxi driver to have one reckless driving incident, or one count of driving under the influence, on his or her record. But as Hayashi told us, stricter background checks make it easier for taxi companies to spot a red flag before making hiring decisions.

The relative insecurity of private background checks raises an unsettling question: How many others with reckless driving records or DUIs drive for TNC companies like Uber, Sidecar, and Lyft without the companies’ knowledge?

The results of a collision can be severe, as San Francisco’s tragic New Year’s eve incident demonstrates. But even those who survive are left with bills that Uber, allegedly, isn’t paying.

 

PAYING NO ONE

Last September, Jason Herrera and Nikolas Kolintzas summoned an Uber driver via smartphone, intending to hop from Valencia Street to the Marina district. Driver Bassim Elbatniji responded, and drove the pair down Octavia, where his Prius collided with a Camry.

Herrera suffered a concussion and was knocked unconscious. Kolintzas also suffered a concussion, and they both sustained injuries to their necks and backs, according to court documents.

But when the two sought financial assistance from Uber to cover their medical costs, Uber said it was the driver’s responsibility.

“As far as Uber’s concerned, their insurance isn’t providing any of this,” attorney Colleen Li told the Guardian. Li is representing Kolintzas and Herrera in their suit against Uber, which seeks damages to cover their medical bills, which reached “tens of thousands” of dollars, Li told us.

According to a policy published on Uber’s website, the company maintains a $1 million “per incident insurance policy applicable to ridesharing trips,” which is in keeping with requirements under the new CPUC regulations.

Nevertheless, Uber has not stepped up to cover damages in response to a lawsuit arising from a similar incident. Months ago, the Guardian reported on the case of an Uber driver who hit a fire hydrant, which flew through the air and struck Claire Fahrbach, a barista living in San Francisco (“Lawsuit over injury from airborne fire hydrant tests Uber’s insurance practices,” 8/8/13). She sustained lacerations to her body, a fracture in her lower leg, and multiple herniated discs, according to her lawsuit against Uber.

Her medical bills and injuries destroyed her dreams of living in San Francisco, and she moved home with her parents in North Carolina to recover. Her lawyer, Doug Atkinson, told us Uber still hasn’t paid for his client’s medical services.

“They’re still denying they have any liability for the driver,” he said. “They said they wouldn’t fight the CPUC ruling, but in our case they obviously are.”

But the hydrant also sprouted a geyser that flooded a nearby business, Rare Device, and the apartment building above it. “It was horrible. Our store flooded, we lost a bunch of inventory,” Rare Device’s owner, Giselle Gyalzen, told us.

Her insurance covered the damage, but she’s still trying to recover the deductible from Uber.

Uber directed the lawyers to its terms of service, which tell people up front that they won’t cover anything: “Uber under no circumstance accepts liability in connection with and/or arising from the transportation services provided by the Transportation Provider or any acts, action, behavior, conduct, and/or negligence on the part of the Transportation Provider.”

Meanwhile, the drivers also find themselves in a bind when it comes to obtaining insurance. Given the lack of clarity, state agencies have opted to alert TNC drivers that they’re going without a safety net.

On its website, the California Department of Insurance posted a notice warning, “TNCs are not required to have medical payments coverage, comprehensive, collision, uninsured/underinsured motorist coverage or other optional coverages.” It goes on to explain that TNCs’ liability policies aren’t required to cover bodily injury to the drivers, damages to the drivers’ cars, or damage and injuries caused by an uninsured or underinsured motorist.

And as the Guardian previously reported (“Driven to Take Risks,” 8/6/13), rideshare drivers don’t qualify for commercial insurance since their vehicles are registered as private automobiles, yet insurance companies won’t grant complete insurance coverage to TNC drivers since it’s considered an insufficient safeguard against risk.

Notably, limo drivers who also work for Uber (and get commercial insurance through those companies) don’t have this problem — just those using Uber or other rideshare apps as independent contractors. Taxi drivers are also eligible for commercial coverage.

Is there any way for an independent TNC driver to legally insure him/herself on the road? “Not that I’m aware of,” said Patrick Storm, a spokesperson for the Department of Insurance.

 

FIXING SAFETY

Paul Marron is an attorney for the Taxicab Paratransit Association of California, the group suing the CPUC to tighten up its regulations. In his view, a key test of the new CPUC regulations is whether they’re enforced — and with a bare bones staff, enforcement is likely to be anemic.

“The CPUC does not have the adequate resources to regulate (transportation) safety statewide,” he told us.

As a lawyer for taxi interests competing against rideshares, Marron obviously has skin in the game, so we looked at the numbers.

We compared the staff counts of the SFMTA, the CPUC, and for some perspective, the New York City Taxi Commission.

The SFMTA has 15 employees who oversee San Francisco’s 1,850 taxi cabs. That’s one staff person for every 123 cabs in the city. The NYC Taxi Commission’s staff of 569 oversees 94,500 taxis, town cars and similar liveries, according to their posted annual report. Though the numbers are greater than San Francisco, the ratio is similar: One staff person for every 166 vehicles.

Now for the CPUC. Though it is now tasked with overseeing “rideshare” TNC vehicles, the agency is also responsible for regulating limos and town cars statewide. Public documents obtained by the Guardian show it oversees 1,900 liveries in the Bay Area, and though there are no official numbers, there are an estimated 3,000 rideshare drivers in the city, according to data compiled by the San Francisco Cab Driver’s Association.

The CPUC has a staff of six based in San Francisco, responsible for overseeing an estimated 4,900 vehicles. That leaves the CPUC with one staffer for every 700 vehicles, a ratio wildly out of sync with other vehicle safety regulators.

Hayashi pleaded with the CPUC to allow cities to regulate rideshares on the local level, saying, “You don’t even have the resources to monitor this stuff.”

Sup. Eric Mar met repeatedly with the SFMTA over these concerns, and will hold a February hearing to get to the heart of the safety culture around San Francisco’s TNC rideshares.

CPUC spokesperson Christopher Chow defended its safety regulations and enforcement. “We can clarify or modify our TNC requirements, if needed, particularly the insurance requirements, as we see how the TNCs attempt to comply with the decision’s directives,” Chow wrote in an email. “If we believe there are any issues that should be addressed, we will take action.”

But as things stand, Claire Fahrbach, Giselle Gyalzen, Jason Herrera, Nikolas Kolintas and the family of Sofia Liu are all waiting for that action.
