Why does the mayor appoint supervisors?

The Alameda County Board of Supervisors just found a replacement for Nadia Lockyer, who resigned in April (“amidst a drug and sex scandal,” the Chronicle notes, and you know how much journalists love to use that phrase). The four remaining members of the board deadlocked for a while, then settled on Union City Council member Richard Valle.

All of which makes me wonder, as I often do: Why does the Mayor of San Francisco get to fill vacancies on the Board of Supervisors?

Other county boards fill the vacancies themselves — and if you don’t think the SFBOS can handle that, remember that every two years the 11 contentious folks choose a president, and it doesn’t take more than a few hours, and not that long ago, they chose a mayor.

I don’t know any other situation where the executive gets to choose legislators. The governor doesn’t fill seats in the state Assembly. The president doesn’t fill vacancies in Congress. There’s an important balance of powers issue here, and it has played out to the detriment of democracy in the past. At one point, more than half of the sitting supervisors had been appointed by Mayor Willie Brown. There was no balance; the mayor called all the shots.

Imagine if, instead of the mayor secretly huddling with advisors and choosing a new supe, the Rules Committee took applications and nominations and then the full board, in open session, debated and discussed and voted. The outcome would reflect the much broader perspectives of 10 district supervisors — and the person chosen would owe a debt to all of his or her colleagues, not to the mayor.

You can make a good case that the mayor ought to fill vancancies in other elected offices (sheriff, city attorney, public defender etc.); those are, at least arguably, executive offices. Although I could also make the case that the 11 district-elected supervisors should make those calls.

But that’s a different issue. The clear and obvious anomaly here is that San Francisco’s chief executive gets to choose his own legislators in the event of a vacancy — and that’s just wrong.

Now, in Alameda if they can’t reach a decision, the governor steps in. In San Francisco, with 10 voting supes, it seems highly unlikely that we’d ever see a long-term deadlock, but the mayor could step in the break the tie in that case — or some other city official could, or you could come up with a dozen other solutions. The bottom line is that most of the time, as in Alameda, the board would come to if not a consensus, then a majority vote.

Mayor Lee’s business tax reform will include new revenue

Mayor Ed Lee has acquiesced to labor’s demand that the business tax reform measure being negotiated for the November ballot raise tens of millions of dollars in new revenue, rather than being revenue-neutral as Lee and business leaders had previously insisted, according to Guardian sources in both the business and progressive communities who are involved in the ongoing negotiations.

As we previously reported, SEIU Local 1021 had demanded that the measure – which must be submitted to the Board of Supervisors by Tuesday – raise $30-50 million in additional revenue to prevent cuts to city services and to recapture money the city lost when the largest downtown corporations sued the city in 2001 to invalidate its gross receipts tax. If not, the union threatened to qualify a competing ballot measure that would raise the money, something neither side wants.

Sources say the Mayor’s Office has agreed to structure the tax to raise at least $25 million in new revenue, and some believe they will settle on $30 million, which is being supported by the big technology companies and is probably enough for labor to sign onto the deal.

But a complicating factor is the fact that Lee’s representatives are simultaneously negotiating another ballot measure to create an Affordable Housing Trust Fund that will also need to generate revenue, most likely through an increase in the real estate transfer tax, something the commercial landlords are opposing.

The business community has opposed any tax increases, but it is split between the big technology companies who helped elect Lee and more traditional businesses, including the FIRE (Finance, Insurance, and Real Estate) companies that all observers say are likely to get hit with a higher tax burden whatever the outcome of the current negotiations.

There is an urgency to get this deal done now because of the fast-approaching deadline to introduce ballot measures to the board, and the fact that under state law revenue measure can be passed with only a simple majority of voters only in presidential election years.

 

Sutter’s CPMC deal isn’t healthy

At 10am on Friday, June 15, at the main chambers of the Board of Supervisors, the first of a series of public hearings will be held on specific aspects of the  development agreement governing the $1.9 billion Sutter Health/California Pacific Medical Center proposal to expand and centralize the giant health-care outfit’s health center by building a new 555 bed hospital at Geary and Van Ness. The deal involves demolishing the existing 220-bed hospital at St. Luke’s at Mission and Cesar Chavez and rebuilding a new 80-bed facility, expanding the Ralph K. Davies hospital at Duboce and Noe and closing down the old Children’s Hospital in Laurel Heights.

The hearing will be the first before the Board of Supervisors. Thus far, the project has been before only the executive branch: the Planning Commission and the mayor. After a brief introduction on the overall project the hearing will focus on the issue of jobs.

This is the largest project to be negotiated by the Lee administration — and although the mayor introduced it to the board in May, not one supervisor has yet joined him to sponsor the legislation. That’s an an odd situation given the importance of the project – and the fact that Mayor Lee can usually count on an automatic four votes from the conservative faction of the board. But not this time.

The hearing was requested by a coalition of more than 60 community, neighborhood, labor, and environmental organizations — San Franciscans for Healthcare, Housing, Jobs and Justice (SFHHJJ) — which has been closely following the project for the last two years.  Members of the coalition have already appealed the project’s environmental impact report, passed last month by the Planning Commission, and SFHHJJ has developed a series of amendments to the agreement that it has been pressing on the Board of Supervisors.  Board President David Chiu agreed to set a series of hearings on the project before it voted on, along with the determination of the appeal of the EIR, in  late July.  SGHHJJ hopes to use the hearings to get across the serious shortcoming of the agreement.  In addition, depending upon the appeal of the EIR,  a law suit may well be filed by some members of the Coalition.

In short, what starts next Friday is a big deal.

Not only is it a big deal in the development war that is at the heart of San Francisco politics, but it also is a big deal given what may well be done by the Supreme Court in deciding the constitutionality of all or part of the Affordable Health Care Act. If Obama’s health reform is struck down by the court, in all or in part, which seems almost certain, Sutter/CPMC’s plan will most definitely take on even more importance for the future of health care and its costs in San Francisco.

Sutter currently controls about a third of the market for health care in San Francisco.  With the construction of this project, it will control about 40 percent — a portion most knowledgable observers feel will give it market dominance  and an ability to actually set health care costs in San Francisco. Sutter’s business model — as shown in Berkeley when it took over Alta Bates and elsewhere in the state – demonstrates that  with a dominate market position, it jacks up prices.

As the San Francisco Chronicle noted in 2010: “…Sutter Health Co. has market power that commands prices 40 to 70 percent higher than its rivals per typical procedure — and pacts with insurers that keep those prices secret”.

A US Supreme Court that weakens or strikes down health care reform will simply re-establish the status-quo ante, a situation in which Sutter will thrive.

And that’s why the board’s conservative members are not supporting Mayor Lee’s deal: it simply does not protect the city — itself a major health care consumer for both its workforce and Healthy San Francisco — from Sutter’s history of turning market power into high health care charges.

SFHHJJ want the development agreement amended to place a cap on the costs charged to the city, allowing Sutter no more than 115 percent of the average charged  by  San Francisco’s other private, nonprofit hospitals.  It also wants Sutter/CPMC low charity care payments pegged at an average of what other nonprofit hospitals contribute, and it is calling for rebuilding St. Luke’s in San Francisco medically underserved south east to 180 beds, not the sure-to-fail size of 80 beds.

But there’s even more to deplore about the proposed deal.

In housing, although the EIR showed that a demand would be created for some 1,500 new two-bedroom homes, Sutter/CPMC agreed to only provide funds to build about 90 such homes. Such a massive shortfall will boost housing prices all other San Franciscans will pay.

The project’s impact on public transit at the Geary / Van Ness intersection will be large and ongoing. More than 20,000 new car trips will be generated at that intersection by the new hospital. Plans for a Bus Rapid Transit raised roadway for the 38 Geary — the most used bus line in the city — will have to be altered at an unknown price since the project calls for all auto traffic to enter the site on the Geary Avenue side.

Again, San Francisco taxpayers will be on the hook to pay for these new costs.

But it is the jobs aspect of the deal that is the most distressing. Sutter/CPMC has a long history of labor disputes with its workforce. Last year it replaced nurses who took a day off to protest their working conditions, and a replacement nurse hired by Sutter accidentally killed a patient. Sutter/CPMC refuses to agree to hire all of its 6,000 current employees for the new facilities. It’s requiring them all to apply as new workers, losing all of their seniority, with a real prospect that many currently employed San Francisco residents will lose their jobs once the new facility opens. All that Sutter/CPMC has agreed to do is hire 50 residents a year for four years – 200 new local jobs, total.

The  June 15 hearing will focus on the jobs issue and public comment is sure to be hot on this laughable “commitment” agreed to by the “jobs” administration.

Mecke joins crowded District 5 supervisorial race

Progressive activist Quintin Mecke jumped into the District 5 supervisorial race today, echoing gentrification concerns raised this week by the Guardian and The New York Times and promising to be an independent representative of one of the city’s most progressive districts, a subtle dig at Sup. Christina Olague’s appointment by Mayor Ed Lee.

“The City is at an economic crossroads. As a 15 year resident of District 5, I cannot sit idly by while our City’s policies force out our residents and small businesses, recklessly pursuing profits for big business at whatever cost,” he began a letter to supporters announcing his candidacy, going on to cite the NYT article on the new tech boom that I wrote about earlier this week.

“What we do next will define the future of San Francisco; the city is always changing but what is important is how we choose to manage the change. One path leads to exponential rent increases, national corporate chain store proliferation, and conversion of rent-controlled housing. The other path leads to controlled and equitable growth, where the fruits of economic development are shared to promote and preserve what is great about this City and our district,” Mecke wrote.

Mecke came in second to Gavin Newsom in the 2007 mayor’s race and then served as the press secretary to Assembly member Tom Ammiano before leaving that post last week to run for office. Mecke joins Julian Davis and John Rizzo in challenging Olague from her left, while London Breed and Thea Selby are the leading moderates in a race that has 10 candidates so far, the largest field in the fall races.

Although he never mentioned Olague by name, Mecke closed his message by repeatedly noting his integrity and independence, a theme that is likely to be a strong one in this race as Olague balances her progressive history and her alliance with the fiscally conservative mayor who appointed her.

“Politics is nothing without principles; and it’s time now to put my own principles into action in this race,” Mecke wrote. “District 5 needs a strong, independent Supervisor. I am entering this race to fight for the values that I believe in and to fight to preserve what is great about District 5 and the city. I have brought principled independence to every issue I’ve worked on and that’s what I’ll continue to bring to City Hall.”

In an interview with the Guardian, Mecke said he sees the campaign as a “five-month organizing project” to reach both regular voters and residents of the district who haven’t been politically engaged, including those in the tech sector. He’d like to see the perspective of workers represented in discussions about technology, not simply the narrow view of venture capitalist Ron Conway that Mayor Lee has been relying on.

“Local politics needs new blood,” Mecke said, “it needs to hear from these people.”

8 Washington isn’t getting much better

When the Board of Supervisors approved the environmental impact report for the most expensive condos in San Francisco history, several members of the board said they weren’t entirely happy with the project. Supervisors Christina Olague and Eric Mar both complained about the height and bulk and Olague said she wanted a parking fee.

So now the project is back, and just won approval at the Budget and Finance Commitee — with only a few minor changes. There’s no adjustment to the height and bulk, although the parking has been cut from 255 spaces to 200 and a 50-cent parking surcharge has been added. Sup. Jane Kim wants to be sure that the pool built in the new facility will be open to low-income youth.

But the city’s not getting a dime more than the $11 million in affordable housing money that developer Simon Snellgrove has already offered — despite the fact that the available financial evidence suggests Snellgrove and his partners will make more than $250 million on the deal. Sup John Avalos made clear that the city’s not getting enough out of this project.

So now it goes to the full board June 12 — and if things go according to the normal San Francisco pattern, the developer will get what he wants and the city will get screwed.

See, when you give developers the opening, they take advantage of it. When you let them over the first hurdle with and 8-3 vote, they get pretty confident that they’re going to win. So why would they compromise on more than few details? Why cut the height and bulk when you know you have the votes?

I respect what Eric Mar, Jane Kim and Christina Olague said about their votes on the EIR — but imagine if it had been a 6-5 vote? Snellgrove might have gotten the message that this wouldn’t be easy. He might be calling Olague and Mar and saying: How much less height? How much less bulk? How much more affordable housing? We might have wound up with a much better deal.

Every time — every single time — a developer presents what is supposed to be the last, best deal it’s a scam. Every time the city has said No, the developer has come back and sweetened the pot. That would have happened here, too.

But no. I predict no height and bulk adjustments, no additional affordable housing money — nothing more than what Budget and Finance already got. Which isn’t enough.

Oh, and by the way: Everyone here already knows that I oppose this project because it’s too much housing for rich people, which we don’t need in this city, and puts the city’s housing balance further out of whack. But if we’re going to sell off the waterfront for all the wrong reasons, we should at least get the best deal we can.

Bike advocates have made real progress, but there’s still a long way to go

San Francisco Bicycle Coalition Executive Director Leah Shahum mused on how far this influential advocacy group has come during its 20th Annual Golden Wheels Awards last night, noting that the first such award recognized the commercial landlord at 555 Montgomery Street for installing indoor bike parking.

“Back then, that would get you a Golden Wheel Award,” she said, noting that this year’s award to the Building Owners and Managers Association of San Francisco (BOMA) was for its support of legislation requiring all commercial buildings in San Francisco to provide indoor bike parking. “We’ve come a long way in 20 years, clearly.”

In addition to the majority of the Board of Supervisors who showed up to offer their support, Shahum ticked off a long list of other city and regional officials who ride bikes and understand their potential as an increasingly important transportation option during the era of peak oil, traffic gridlock, and public health problems.

“Regularly, we have these top leaders in the city who are biking because they love it, biking because they’ve always biked,” Shahum said, citing the Sunday Streets road closures and the school district going from discouraging cycling to facilitating it as signs of the pro-bike mindset that has taken hold of San Francisco.

The fact that SFBC recognized BOMA – a powerful downtown player that has progressed from seeing cyclists as enemies to embracing them as allies – was telling of the mainstream embrace of bikes.

“We get it, we’re learning,” Meade Boutwell, president of BOMA’s board, told the crowd as he accepted the award, going on to say that “less cars are good for all of us.”

It was a lovely if ungrammatical sentiment and a sign of just how far the business community has come in accepting the imperative of promoting alternatives to the automobile. But there’s still a bit of a disconnect in San Francisco about the role that bikes play in the world’s great pro-cycling cities, evidenced partly by Boutwell’s opening comment, “Under this polyester suit is lycra.”

Keynote speaker Gil Peñalosa – executive director of 8-80 Cities, a nonprofit that promotes creation of cycling infrastructure that is safe and inviting from those 8-80-years-old – mocked the MAMILs (Middle-Aged Men In Lycra) and the notion that people should be athletic or wear special equipment to be able to cycle in cities.

“We dress normally, we act normal, and so on,” Peñalosa said, later arguing that, “Cycling is for everybody.”

In Boutwell’s defense, much of mainstream San Francisco still has a hard time accepting cycling as a normal, safe option. When the San Francisco Chronicle covered Pealosa’s visit to Sunday Streets last weekend – our version of the car-free ciclovias that Peñalosa pioneered as a city official in Bogota, Columbia more than a decade ago – reporter Sam Whiting was jarred by the guest’s casual approach.

“They had come from overseas and were riding in jeans and without helmets, both rookie mistakes,” he wrote of Peñalosa and his wife (“Sunday Streets welcomes its source of inspiration,” 6/4).

But Peñalosa argues that the real mistake is when cities cater primarily to automobiles at the expense of the safety and livability of their neighborhoods, and treat cycling as a dangerous fringe activity. He argues that cities should be built primarily around pedestrians, “but very close to the pedestrians is the cyclists…I think that cycling is just a more efficient way of walking.”

Public transit is important and should be robust, he said, but it’s just not as efficient, user-friendly, economical, or environmentally beneficial as bikes. “We need to walk and bike as a part of everyday life and then we’ll be much healthier,” he said.

Peñalosa urged the crowd to be politically active and push the city to prioritize bikes over automobiles, noting that even in wealthy neighborhoods, only about a third of residents drive cars. And from a design perspective, he said city officials must choose between “Streets for cars or streets for people.”

Once we make the latter choice, Peñalosa laid out an agenda for achieving that goal, starting with slowing vehicle speeds to no more than 20 mph in residential areas.

He cited statistics showing that only about 5 percent of pedestrians hit by cars driving 20 mph will die, whereas the fatality rate shoots up to 80 percent when the vehicles are traveling 40 mph. And for streets in which cars are traveling faster than 20 mph, he said it’s imperative to have bike lanes that are separated from cars by physical barriers, rather than just lines painted on the street.

He noted that Seville, Spain drastically increased its cycling rate in just a few years by committing to building bike infrastructure, and that Chicago Mayor Rahm Emanuel installed that city’s first physically separated bikeway within his first 30 days in office and has perhaps the US’s most ambitious program for installing new bikeways. “San Francisco should not be any less than Chicago,” he said.

In Cogenhagen, which already boasts some of the world’s highest rates of urban bicycle use, Peñalosa said the city has sought to capture more long-distance riders by building 200 miles of “cycle superhighways” – which includes two lanes in each direction to facilitate both fast and slow riders – all for the price it costs to build about a half-mile of subway.

The goal, he said, is to make cycling as “easy, fast, and convenient” as possible, and to apply the political pressure to make that a priority because “if you aren’t doing those things then someone else is and someone else is setting the agenda.”

Wage theft task force approved

The Board of Supervisors June 5 voted unanimously to create a wage theft task force. The task force will make recommendations to city departments concerning the prevention and correction of wage theft in the city.

Wage theft refers to employers paying less than their employees are due, and can include not paying extra for overtime, not allowing breaks, confiscating tips, and paying less than minimum wage. A 2010 study of labor conditions in Chinatown restaurants conducted by the Chinese Progressive Association (CPA) found that some 76 percent of employees did not receive overtime pay when they worked more than 40 hours in a week, and roughly half were not being paid San Francisco’s minimum wage.

The industries where wage theft is prominent range from restaurants and retail to domestic work. 

Approval of the task force is a step forward for groups like CPA that have been working to combat wage theft for years. It builds on the wage theft prevention ordiance, passed last July. The ordinance doubled the fine for employers who retaliate against workers that seek recourse for wage theft, and enhanced the power of the cit’s Office of Labor Standards and Enforcement (OLSE).

The Progressive Workers Alliance- a coalition of CPA, Young Workers United, the Filipino Community Center and others- advocated for the task force and helped bring in dozens of supporters to the meeting. 

Workers who suspect that their employers have violated local labor laws often come to these groups for help. Between the OLSA and advocacy groups, the people following up with these claims see a widespread problem. According to Shaw San Liu of the CPA, there are “probably hundreds if not thousands coming forward every year, and there are many more who don’t.” 

“There have been experiments in coordinating with the City Attorney and with the health department to revoke food permits,” said Liu. 

She hopes “the task force will build off these successful examples and see how we can expand them to a more comprehensive strategy.”

 

Welcome back to SF President Obama! Now, say Supevisors, give us our marijuana

Not that it’s ever a good idea, but avoid driving downtown today like the plague — President Obama’s in town! And, (as reported by SFGate), SF supervisors want him to take a stance on pot. Sup. Christina Olague has penned a letter co-signed by Sups. David Campos, and Scott Weiner that is a solid finger-wag at the current federal administrations actions against the medical marijuana industry. Here’s the meat of it:

 

We believe strongly in addressing medical cannabis as a public health issue, and we will strive to fully implement state law by protecting not only our patients, but our property owners and dispensary operators as well. We want to work with President Obama on a public health solution for medical cannabis at the federal level, once he wins a second term. In the meantime, the Department of Justice must respect our laws and honor the President’s commitment on this issue. Honoring this commitment can start by taking no further action against the nine landlords of City-permitted facilities here in San Francisco.

 

Those “nine landlords” refer to the property owners of the five SF cannabis dispensaries that have already closed, and the additional four that are set to close this month. The federal government has sent threatening letters to dispensary landlords that posit extensive jail time and civil forfeiture for those landlords that continue to allow federally-illegal drug trafficking on their property. 

Kudos to the new Sup. Olague for taking a stand. Of course, the letter’s premise is that the Sups. are staunch supporters of Obama’s re-election, they’re just asking him to improve on this particular issue. It begs the question: why would he make capitulations to win support that is already in pocket?

Tickets are sold out for his lunch at the Julia Morgan Ballroom (465 California, between Montgomery and Sansome Streets), although his campaign website encourages you to get on the waiting list — be careful, general admission tickets start at $5,000. The President’s only other scheduled stop, says SFGate, is at a “small roundtable” at One Market Plaza. 

Afterwards, the President will head south to Los Angeles to attend the annual fundraising gala for the LGBT Leadership Council, where he will no doubt be greeted affectionately for his “I support gay marriage”isms of last month. 

Supervisors dominate DCCC race, but key newbies join them

“I just stopped by on my way to finish campaigning,” Sup. David  Campos told me at the Bike Coalition’s 20th Annual Golden Wheel Awards (more on that tomorrow), the first in more than a majority of the Board of Supervisors at the event.

Campos was campaigning for reelection to the Democratic Party County Central Committee (DCCC) and the polls were still going to be open for almost two more hours. Perhaps he could still reach the one in four registered SF voters who bothered to weigh in on this lackluster election.

“There was nothing really on the ballot that excited voters,” Campos said. “Hopefully November will be different.”

Tonight’s returns — for leadership of a local Democratic Party that hopes for more  voter engagement in the fall races — showed that Campos and fellow supervisors David Chiu, John Avalos, and Scott Wiener expectedly topped the pack, with Bevan Dufty, who moved from the board to the Mayor’s Office this year, in fifth place. And longtime former legislator Carole Migden’s sixth place fininish in the 14-seat eastside DCCC race helped show that it was mostly about name recognition.

But there were a couple of first-time candidates in the winning field: Matt Dorsey and Zoe Dunning, who finished 8th and 12th respectively. Both played key roles in recent LGBT politics: Dorsey as the City Attorney’s Office spokesperson during the same-sex marriage saga of the last eight years, Dunning as a poster lesbian in ending the US military’s “don’t ask, don’t tell” policy.

“I think Zoe and Matt are the ones to watch,” DCCC member Alix Rosenthal told me at the Buck Tavern as she celebrated her reelection, after campaigning hard for both the progressive and women’s slates.     

Unprompted, Dorsey returned the recognition when I stopped by his party down the street at Churchill. “Alix and Rafael [Mandelman, who organized the progressive slate and finished 10th, right after Sup. Malia Cohen] ran other things, so it’s apples and oranges,” Dorsey humbly said of the two former Dist. 8 supervisorial candidates he bested, when I asked about his strong finish.

Dorsey ran an aggressive campaign, targeting high-turnout precincts and working hard to get the full spectrum of political endorsements (and posting all his answers to each group online), what he called “Moneyball politics.” And it translated into an impressive finish for a freshman candidate but longtime politico.  

“Right now, I’m looking to get back to the gym after a year and a half of campaigning,” said Dorsey, the spokesperson for the mayoral campaign of City Attorney Dennis Herrera, who was at the party, along with District Attorney George Gascon. 

Dorsey and his fellow Guardian/progressive slate members did better in Eastside Dist. 17 than Westside Dist. 19, taking 10 of 14 seats compared to four of 10, leaving a near-equal balance with the moderate Democrats once the seats of elected officials are factored in.

But if the spirits count for anything, Dorsey told me he ran especially hard to earn the seat that outgoing DCCC Chair Aaron Peskin appointed him to when long progressive activist Michael Goldstein died last year.

“Knowing that it was his seat,” Dorsey said, “motivated me to work harder.”

Mayor Lee’s priorities are wrong

OPINION There was much back slapping at City Hall last week as officials congratulated themselves on what was described as a welcome “philosophical shift” in San Francisco politics.

The beneficiary of the acclaim and virtual political consensus was Mayor Ed Lee’s proposed budget, the largest in history — including an unexpected windfall of new revenue. The budget’s signature element, described in glowing terms by the San Francisco Chronicle’s C.W. Nevius and warranting its own special mayoral press conference, is the expansion of the police and fire budgets — an $82 million increase over two years.

Amid last week’s ovations was an unsettling silence from voices normally willing to cut through obscure numbers and rhetoric. Not one official commented that the best way to ensure public safety is to build strong children, families, and communities.

The cumulative impact of the devastating state budget and years of inadequate funding on families and children should not permit celebration. In light of millions in unanticipated revenue, politicians should not be satisfied with addressing urgent needs simply by sparing a few city departments from cuts, as appeared to be the case. Here’s what they should be thinking about:

• Our schools face the worst budget cuts ever, with SFUSD preparing to lay off 400 employees, reduce the already-too-short school year, increase class size, eliminate most school bus lines and all high school after-school programs, and under-fund everything from food to special education.

• Our childcare system is being gutted by the state, with $20 million in losses this year on top of $9 million from last year. This will impact thousands of families and result in the closure of centers and family childcare homes. Many fewer parents will be eligible for childcare subsidies (no one with two kids earning more than $37,500 a year will qualify) — pushing parents out of work and onto “welfare,” and children out of quality care and into unsafe settings.

• Support systems for children with disabilities are being eliminated and reduced through simultaneous cuts in multiple agencies.

• Young people entering community colleges or state universities face years of uncertainty — including whether their campuses will even exist. Already, the majority of SF students who enter City College are unable to graduate — stymied by costs, lack of educational support, or the inability to get classes they need.

It appears that little of the new millions will address these problems. The mayor’s budget does not even fully fund the voter-approved Public Education Enrichment Fund, passed in 2004 to provide essential services to public schools and preschools. Funding falls short by more than $10 million. Providing schools the funds to which they are legally entitled is the least we can do when the city lands millions in new resources.

Let’s be clear: crime is at historic lows — and has gotten that way with 200 fewer officers than the mayor is now advancing. There is little rationale to suddenly swell the ranks, at a cost of $140,000 per officer. The Fire Department’s inefficiencies have been well documented by city budget experts, and many cost-saving recommendations have yet to be implemented.

Before signing off on a budget they have not yet discussed in public (as it appeared to last week), the Board of Supervisors must evaluate fiscal options in full view. Private meetings with the mayor are no substitute for a robust debate now that the revenue facts are known. This is the city’s first two-year budget, and its policy direction will impact us all for years to come.

What looks to Nevius like a positive “drama-free, signature moment” for San Francisco, looks to many advocates for children and families like an abdication of responsibility.

Mayor Ed Lee and his attorneys are presenting a voluminous yet largely speculative case against suspended Sheriff Ross Mirkarimi in their effort to remove him for official misconduct, broadening the case far beyond their most damning core accusation -– that Mirkarimi dissuaded witnesses from telling police that he bruised his wife’s arm during an argument on Dec. 31. And so far, there’s no evidence to support that key allegation.

In fact, Mirkarimi and his attorneys insist there was no effort to dissuade witnesses, one of many unsupported aspects to a case they say should never have been filed without stronger evidence. And they say the mayor’s team is now compensating for the weakness of its case by piling on irrelevant accusations and witnesses in an effort that amounts to character assassination.

There are even signs that the city is nervous about its case. Knowledgeable sources told the Guardian that the City Attorney’s Office last week offered to settle the case with Mirkarimi, offering a substantial financial settlement if he would agree to resign, an offer that Mirkarimi rejected.

It was one of a series of rapidly unfolding developments that also included a raucous Ethics Commission hearing, the disclosure of phone records by Mirkarimi’s side, a new list of charges, and the city’s release of the video Mirkarimi’s wife, Eliana Lopez, made with neighbor Ivory Madison, documenting the bruise in case of a child custody battle over their son.

Lopez has maintained that Mirkarimi never abused her and that she’s been hurt most by the efforts to prosecute him and remove him from office.

“I hope they realize after reflection that what they have done is irreparable and perpetually damaging to me and my family,” Lopez said in a statement condemning the city’s release of a video that she fears will remain online for her children and grandchildren to see.

Yet all indications are this spectacle is only going to grow more sordid, divisive, and sensational as it moves forward — belying the statement Lee made last week as he introduced his annual budget: “As many of you know, I’m a person who does not like a whole lot of drama.”

SIMPLE OR COMPLEX?

The May 29 Ethics Commission hearing to begin setting standards and procedures for the official misconduct proceedings against Mirkarimi illustrated two sharply divergent views on when elected officials should be removed from office. It also displayed the increasingly bitter acrimony and resentments on each side, emotions only likely to grow more pronounced as the hearings drag on for months against the backdrop of election season.

Both sides would like to see the decision as a simple one. Lee and his team of attorneys and investigators say Mirkarimi’s bruising of his wife’s arm and his unwillingness to cooperate with their investigation of what followed make him unfit for office. Mirkarimi and his lawyers admit his crime, but they say that’s unrelated to his official duties and that the rest of Lee’s charges against him are speculative and untrue.

Yet there’s nothing simple about this official misconduct case — or with the implications of how each side is trying to counter the others’ central claims. So despite the stated desires of some Ethics commissioners to narrow the scope of their inquiry and limit the number of witnesses, San Franciscans appear to be in for a long, dramatic, and divisive spectacle, with Mirkarimi’s fate decided by the Board of Supervisors just a month or so before the five supervisors who have been his closest ideological allies face reelection. Nine of 11 votes are required to remove an official.

The Mayor’s Office wants to call the most witnesses and present an elaborate (and expensive) case that includes a number of outside experts on law enforcement and domestic violence, painting a portrait of Mirkarimi as a serious wife-batterer whose past and future actions can be divined from that malevolent distinction, making him obviously unable to continue as San Francisco’s chief law enforcement officer.

“The extent of the abuse was far greater than what Mr. Mirkarimi has testified to,” claimed Deputy City Attorney Peter Keith, going on to say “there were attempts to control what she ate,” an apparent reference to Mirkarimi’s decision not to take Lopez to a restaurant for lunch on Dec. 31 because they were having a heated argument. He also repeatedly referred to Mirkarimi as a batterer and said “batterers behave in a certain way.”

Mirkarimi attorney Shepard Kopp calls that portrayal exaggerated and unfair, ridiculing the Mayor’s Office claims that its domestic violence expert, attorney Nancy Lemon, can predict Mirkarimi’s behavior based on grabbing his wife’s arm once: “Apparently she’s some kind of clairvoyant in addition to being an expert,” Kopp told the commission as he unsuccessfully sought Lemon’s removal from the witness list.

Ethics Commission Chair Benedict Hur took the lead role in trying to limit the witness list, focusing on stripping it of the various law enforcement experts who plan to describe how different agencies might react to dealing with Mirkarimi. “What I don’t understand is how his ability to do his job relates to whether he committed official misconduct,” Hur said.

Mirkarimi’s team says its case could be very simple, with only Lee and Mirkarimi called as live witnesses — but the attorneys reserved the right to offer testimony to counter false or damaging claims made by the Mayor’s Office.

Hur tried to limit the case to just witnesses and arguments that relate to Mirkarimi’s actions, but he was outvoted by those who wanted to let the city argue how those actions would affect perceptions of Mirkarimi by the many people that a sheriff must interact with.

In the end, the commissioners agreed to trim the eight expert witnesses sought by the mayor down to three and to cut its 17 proposed fact witnesses down to 12, calling 15 total witnesses. Mirkarimi’s team will call 10 witnesses, down from an initial 17. All witnesses will submit written declarations and then be subjected to live cross-examination if any of their testimony is disputed.

EVIDENCE AND SPECULATION

The speculative and prejudicial nature of some of the city’s case was attacked at the hearing by Mirkarimi’s attorneys and the large crowd that came to support him.

Commissioner Paul Renne asked the Mayor’s Office attorneys why they hadn’t summarized the expected testimony of their expert witnesses and “How are any of those opinions relevant to the issues in this case?”

“I have not had time to work with the witnesses to see what their opinions are,” replied Deputy City Attorney Sherry Kaiser, prompting Kopp to incredulously note, “The mayor is preparing the expert witnesses without knowing what their testimony will be. How can I respond to that?”

The issues of bias and conflicts of interest also came up surrounding what sources should be called as witnesses. Mirkarimi’s team wanted longtime Sheriff Michael Hennessey, Mirkarimi’s predecessor, while the Mayor’s Office pushed for Acting Sheriff Vicki Hennessy to convey how the Sheriff’s Department should function.

“Vicki Hennessy was a political appoint of Mayor Lee,” Waggoner objected, although the commission decided to use that appointee.

On several critical procedural questions, the commission sided with the Mayor’s Office, ruling that the commission decision needn’t be unanimous, that guilt could be established based on a preponderance of the evidence rather than beyond a reasonable doubt, and that normal rules of evidence won’t apply, with some hearsay evidence allowed on a case-by-case basis.

The pro-mayor decisions angered the roughly 200 Mirkarimi supporters who packed the commission hearing and an overflow room, many bearing blue “We stand with Ross” stickers and flyers, which had “Respect Eliana” on the flip side. There were only a couple of Mirkarimi critics at the hearing wearing white “I support Casa de las Madres” stickers, referring to the domestic violence group that has been calling for Mirkarimi’s removal since shortly after the incident went public.

Mirkarimi got a rousing welcome from the crowd when he arrived at the hearing, his voice choking up and eyes welling with tears as he said, “I cannot tell you, on behalf of me and my family, how grateful we are.”

The crowd was boisterous during the proceedings, loudly reacting to some claims by the deputy city attorneys and offering comments such as “Ed Lee is the one you should put on trial,” with Hur finally recessing the hearing after an hour and having deputies warn audience members that they would be removed for speaking out.

Renne, a career litigator and the District Attorney’s Office appointee to the commission, raised the most doubts about both the standard of guilt and rules of evidence being lower than in criminal proceedings, telling his colleagues, “I have some reservations.”

PHONE LOGS

Mirkarimi’s team also released to the Chronicle and the Guardian redacted phone records from Mirkarimi, Lopez, and Linnette Peralta Haynes — a family friend and social worker who served as Mirkarimi’s last campaign manager. The city has sought to portray Haynes, who has not been cooperating with the investigation, as a conduit to Mirkarimi’s efforts to dissuade Lopez and Madison from going to the police on Jan. 4.

Mirkarimi previously told the Guardian that he was unaware that Lopez had told Madison about the abuse incident or that they had made a video of her injury until several hours after Madison had called the police and they had come to the house to talk to Lopez, during which time Mirkarimi was in a series of meetings at City Hall.

The phone records seem to support that claim. They show that Lopez and Haynes — who is close to Lopez and recently went to Venezuela to visit her — exchanged a series of telephone calls on Jan. 4 starting at 11am. Their longest conversation, nearly 40 minutes, occurred at 11:18am.

Neither woman could be reached to describe the substance of that call. At 12:24pm, Lopez sent Madison — with whom she had been communicating by phone and text over the previous couple days — a text message indicating that she didn’t want Madison to report the incident to police, but that she would instead go to her doctor to document the injury.

A minute later, Madison called the police to report that Lopez had been abused by Mirkarimi.

Starting an hour later, the records show, Haynes and Lopez called each other but didn’t connect until 3:31, when they had a nearly 14-minute phone conversation, presumably discussing the fact that police had visited the house, with Lopez reportedly giving the phone to Madison at one point so Haynes could talk to her.

Yet the phone records indicate that neither Lopez nor Haynes tried to reach Mirkarimi until after that conversation, despite the city’s claims that Mirkarimi “or his agents” used his power to dissuade witnesses, most notably Lopez and Madison. The first attempt to reach Mirkarimi was at 3:46pm when Haynes called him twice but didn’t connect. Lopez then sent Mirkarimi a text message at 3:53pm asking “Where are you and where is the car,” but she got not reply. She texted him again at 4:18pm to say “Call me. It’s an emergency.”

Lopez made one last appeal to Madison in a 4:18pm phone conservation that lasted four minutes and 27 seconds and then she finally reached Mirkarimi by phone at 4:23pm. Mirkarimi and attorney David Waggoner say this is the first time that he became aware that Lopez had talked to neighbors and that the police had been called. Their conversation lasted a little more than five minutes.

Mirkarimi called Haynes at 5:12pm and they spoke for seven minutes. At 5:51pm, an increasingly panicked Lopez sent a text to Mirkarimi saying, “You have to call [Sheriff Michael] Hennessey and stop this before something happen. Ivory is giving the investigators everything. Use your power.” To which Mirkarimi responded 10 minutes later, “I cannot. And neither can he. You have to reject Madison’s actions. We both do. I cannot involve new people.”

NEW CHARGES

On June 1, the city released an amended list of charges against Mirkarimi that was intended to be a more specific list of accusations, as Waggoner requested during the May 29 Ethics Commission hearing. In it, the city asserts that the charter language essentially gives the city two avenues by which to remove officials, defining distinct “wrongful behavior” and “required conduct” clauses. Violation of either, they contend, is enough to remove an official.

“Official misconduct means any wrongful behavior by a public officer in relation to the duties of his or her office, willful in its character, including any failure, refusal or neglect of an officer to perform any duty enjoined on him or her by law…,” begins the charter language. This “wrongful behavior” section has long been in the charter, referring to specific actions by public officials to neglect their duties.

The second “required conduct” clause of this sentence — which was created in 1996, never vetted by the courts, and which Mirkarimi’s attorneys say is unconstitutionally vague — continues, “…or conduct that falls below the standard of decency, good faith and right action impliedly required of all public officers and including any violation of a specific conflict of interest or governmental ethics law.”

In trying to indict Mirkarimi for actions before he was sworn in as sheriff, the city attempts to argue that his official duties really began with his election, claiming that in this interim period he “had the duty and the power in his official capacity as Sheriff-Elect to work with the Sheriff’s Department and its officials to prepare himself to assume the full duties of Sheriff.” And if that’s not enough, the city argues that he was chair of the Board of Supervisors Public Safety Committee during that same Nov. 8-Jan. 8 time period, further subjecting his actions to official misconduct scrutiny.

The “wrongful actions” charges against Mirkarimi were listed in the document as domestic violence, abuse of office, impeding a police investigation, and “crime, conviction, and sentence,” while the “breach of required conduct” charges were listed simply as his sheriff and supervisorial roles.

The document then attempts to paint an expansive portrait of the Sheriff’s official duties, going beyond the narrow construction of the charter to include the general law enforcement duties listed in state law, interactions with various government and nonprofit groups, administrative responsibilities as a city department head, and passing mentions in the California Family Code that police officers “must enforce emergency protective orders in domestic violence cases.”

Yet the promise that the rest of the document would detail Mirkarimi’s wrongful actions with greater specificity than the previous list of official charges doesn’t seem to be met by this document, which repeats the same narrative of actions that Waggoner had criticized for vagueness.

For example, on the pivotal charge that he dissuaded witnesses and impeded the police investigation, the new charges say that during the period from Dec. 31-Jan. 4, “Sheriff Mirkarimi participated in and condoned efforts to dissuade witnesses from reporting this incident to police and/or cooperating with police investigators,” without describing any specific witnesses or actions that he took.

And by the mayor’s team’s own admissions, the prosecutors don’t know what Mirkarimi did to dissuade witnesses, which they hope to learn through future testimony.

The closest the new document comes to directly tying Mirkarimi’s actions to the official misconduct language is with Mirkarimi’s plea to a misdemeanor false imprisonment charge: “False imprisonment of a spouse is a crime of domestic violence. The California Penal Code considers spousal abuse to be a ‘crime against public decency and good morals.'”

Mirkarimi disagrees with that interpretation, noting that he and his attorneys specifically considered whether pleading to false imprisonment -– a general charge with many possible meanings -– would violate the city’s official misconduct provisions, and he told the Guardian that he was assured by his attorneys it didn’t. Mirkarimi told us he would not have entered the plea and would have instead fought the charges in court if he thought it would disqualify him from serving as sheriff.

Waggoner told us that “The Mayor’s Amended Charges are further evidence that this entire ordeal is a political hatchet job reminiscent of a Soviet show trial. Far from being a careful analysis of any actual evidence, the new charges are vague, redundant, and conflate the offices of Sheriff and Supervisor.”

But ultimately, the case against Mirkarimi is a political one, not a legal case subjected to the normal standards of evidence and procedure. And whether Mirkarimi keeps his job will be a decision made by politicians based on a variety of factors, some of which have little relation to whatever happened on Dec. 31 and Jan. 4.

Don’t water down campaign laws

EDITORIAL The San Francisco Ethics Commission, which is hardly aggressive about cracking down on campaign-finance violations, has suggested some rule changes that would water down the city’s ethics laws. The supervisors should reject most of the suggestions — and start talking about real reform.

The commission has asked Sup. Scott Wiener to bring the changes to the board, and Wiener told us that he has problems with some of them and is going to be working with his colleagues, particularly Sup. David Campos, to fix the package.

It will need a lot of amendments to be acceptable.

The current proposal would make life easier for campaigns and big donors, but would make it harder for the public to figure out who’s putting up the money and where it’s going. For example, it would exempt from the spending cap all money spent complying with the ethics laws. That sounds fair at first glance — but the amounts involved are huge. For a mayoral race, as much as $147,000 would be exempted. That’s a lot of money for “compliance.”

More important, the ethics proposal would eliminate the restrictions on how much a single donor can give in an election season. Right now, the cumulative limit is $500 for each office on the ballot, which limits the impact that a handful of big-money contributors can have on an election. Under the new rule, a wealthy person who wants to make sure that every politician in town owes him or her can donate the maximum to a long list of candidates, giving more power to a few.

Wiener says that under ranked-choice voting, donors should be able to give to more than one candidate for a single office. Fine — but the cap doesn’t have to be eliminated. It could easily be amended to account for RCV.

The plan would somewhat loosen the reporting requirements in the last days of a campaign, eliminating weekend disclosures. It would decrease the transparency rules for campaign committees that shuffle money back and forth to hide its true source. It would aalow more spending by independent committees with less disclosure.

In other words, it would undermine the ability of the voters to know who is funding which candidates and initiative campaigns. There’s no reason to do any of that.

The problem with the current law is not that it requires too much disclosure — it’s that, in many ways, the controls on political money are too weak. And if the supervisors are serious about reform, there’s plenty to be done.

Ethics laws currently bar anyone who is seeking a city contract from donating to local officials. But it’s still perfectly legal for someone seeking a permit or zoning change to throw around cash. And there are endless problems with developers who need city officials on their side. Extending the contribution ban to anyone seeking special zoning or permit approval for any project with construction costs above a certain threshold — say, $10 million — would exclude, say, homeowners who want to build a new deck, but would limit the role of real-estate money in campaigns.

The amendments need eight votes to pass; before it even gets to the full board, the Rules Committee ought to ship this mess back to the Ethics Commission and tell the supposed watchdogs to try again.

Vote yes on Prop A for competitive bidding for garbage and against Recology monopoly

As a reporter for the old Redwood City Tribune in 1965 or so, I got a call one day from the late  Luman Drake, then an indefatigable environmental activist in Brisbane.  “Bruce,” he said, “you are good at exposing scandals on the Peninsula, but you have missed the biggest scandal of them all. Garbage, garbage in the Bay off Brisbane, garbage alongside the Bay Shore going into San Francisco.”

He then outlined for me, his voice rising in anger, how the scavengers of an early era had muscled through a longtime contract to dump San Francisco’s garbage into the bay alongside the Bay Shore freeway.  And, he said, they are still doing it. Why can’t you fight it? I asked naively.

“Fight it, fight it,” he replied. “The scavengers are the most powerful political force in San Francisco and there’s not a goddamn thing we can do about it.” I checked out his story, then and through the years, and he was right.  Everyone driving in and out of San Francisco could watch with horror  for years as the scavengers kept dumping San Francisco garbage into a big chunk of the bay.  (Note the oral history from Drake and then Mayor Paul Goercke and others who fought the losing fight for years to kick out the scavengers from Brisbane.) http://legendarymarketingenius.com/oralhistorySBMW.html)

Five decades later, the scavengers are still a preeminent political power in San Francisco. The scavengers (now Recology) have operated since 1932 without competitive bidding, without regulation of its high residential and commercial rates, without a franchise fee, and without any real oversight. Finally, after all these years as king of the hill, Recology’s monopoly is being challenged by Proposition A, an initiative aimed at forcing Recology for the first time to undergo competitive bidding and thereby save city residents and businesses millions of dollars  in rates and service.

Let me say up front that I salute former State Senator and retired Judge Quentin Kopp and Tony Kelly, president of the Potrero Hill Boosters and the Guardian’s candidate for District l0 election (Potrero Hill/BayView/Hunters Point). They have taken this measure on when nobody else would, without much money or resources, and up against  a $l.5 million campaign by Recology and enormous, nasty political pressure.  I also salute those who publicly signed on to their brochure: Coalition for San Francisco Neighborhoods, San Francisco Tomorrow, SF Human Services Network, David Bisho,Walter Farrell, George Wooding, Irene Creps, Alexa Vuksich, the San Francisco Examiner, SF Appeal.com, and the Guardian. 

I was delighted to get a Yes on A brochure at my house in West Portal and find that Kopp and Kelly et al had money enough to make a strong statement in a strong  campaign mailer.  Kopp and Kelly persuasively summarized the key points for A and against more galloping  Recology monopoly in the brochure.  Meanwhile, the  Recology forces have been  using  gobs of money, a massive mail campaign, robot calls, and deploying the kind of political muscle their predecessors used to keep dumping garbage in the bay off Brisbane for decades. Since the Yes on A camp has trouble cutting through the cannonading and the flak, let me lay out the A  arguments verbatim from its brochure.

Question in the brochure:  “Why is Recology spending millions to buy this election? Recology has contributed $l,580,292.70 against Prop A. (Form 460 SF Ethics Commission.” Answer in the brochure;  “So they can raise your garbage rates after the election! ‘San Francisco Prepares For Recology to Raise Garbage Rates’ (Contract is Proof Recology Plans to Hike Garbage Rates Following Election’”) Then they laid out l0 reasons to vote Yes on A.

1. “71 Bay Area cities have competitive bidding or franchise agreements for garbage services. Because San Francisco doesn’t, residential trash collection rates have increased 136% in the last 11 years, with another massive increase coming after the election! We pay more than twice as much for garbage and recycling as San Jose, a city with twice the land and about 400,000 more people.

2. “The garbage collection/recycling monopoly now grosses about $220 million per year from the city’s residents and businesses, without any regulation of commercial rates.

3. “How did we end up paying so much? In 2001 the monopoly requested a 52% rate increase, Department of Public Works staff recommended 20% and the then DPW director (now Mayor) Ed Lee granted a 44 %rate increase. That’s why the Examiner said: ‘no-bid contracts generally make for dirty public policy, and this includes…The City’s garbage collection monopoly…’

4. “Don’t believe the monopoly’s 78% recycling rate claim backed only by its puppet city department. A former Recology recycling manager has testified under oath that fraudulent reporting, excessive state reimbursements and even kickbacks to and from Recology employees are behind this bogus claim.  Another ‘whistleblower’ has revealed that even sand removal from the Great Highway was included in this 78%.

5. “With a far smaller population, Oakland receives $24 million each year as a franchise fee, which supports city services and prevents other tax and fee increases.  San Francisco receives zilch from the monopoly holder in franchise fees for our General Fund.

6. “Proposition A is on the ballot through citizen/ratepayer time and effort, in the face of intimidation and harassment by the monopoly’s agents and its multi-million dollar campaign against it.

7. “Proposition A is simple: it authorizes the Director of Public Works and the Board of Supervisors’ Budget Analyst to prepare competitive bidding regulations for residential and commercial collection, recycling, and disposal, by modifying an outdated 1932 ordinance.

8. “Like all other competitive-bid city contracts, the winning garbage service bid will be ratified by the Board of Supervisors without any political tinkering.  The winning bid will contain the best deal for city ratepayers.

9. “If the monopoly is truly the corporation portrayed in its expensive campaign to defeat Prop A, it would easily win every bid.  As the Examiner stated last year, ‘…contracts won by competitive bidding are always better for the public in the long run.’

10. And then the list of endorsers ‘and tens of thousands of other ratepayers.’”

Kopp and Kelly et al are providing a major public service by challenging an arrogant monopoly of an essential public service and keeping alive the concept of competitive bidding on city contracts in San Francisco.   I drink to them from a pitcher of Potrero Hill martinis. Election turnout expected to be less than 40 percent

If they held an election and nobody noticed, would it still count? Because that’s what this Tuesday’s presidential primary election is starting to feel like: the election that everyone ignored.

Okay, okay, not everyone is ignoring this election. San Francisco Elections Director John Arnst tells us that his department has received about 55,000 mail-in ballots so far out of the nearly 217,000 they sent out, a turnout of about 25 percent. And 1,110 voters have cast their ballots in person during early voting at City Hall as of this afternoon, a level lower than the 2010 or 2008 primaries “by quite a bit,” Arnst said.

That’s not really surprising given that both major political parties have already chosen their presidential candidates, there are no other offices being seriously contested, and the rest of the ballot consists of the Democratic County Central Committee (and its Green and Republican parties counterparts) races and a pair each of ho-hum statewide and local ballot measures. The most interesting one is Proposition A, which seeks to break Recology’s waste collection monopoly in San Francisco by requiring competitive bidding.

“If the garbage issue is the most exciting issue on the ballot, you know it’s the most boring election ever,” says Tony Kelly, who is leading the campaign for Prop. A.

With the exception of a press conference that Kelly and other Prop. A supporters held last week to accuse Recology of being complicit in an alleged recycling kickback scheme by some of its employees, there’s been little to indicate Prop. A has much chance of success given that almost every endorsing group (except the Guardian) opposes the measure.

“Goliath doesn’t lose very often, and we’re being outspent 100 to one,” Kelly said, expressing hopes that the measure can at least garner 35-40 percent of the vote to send a message that Recology should work with the city to allow competitive bidding on some of its contracts.

But with turnout expected to be low, Recology isn’t taking any chances. Its political consultant, Eric Potashner, says the campaign has been assembling up to a couple hundred volunteers and its SoMa headquarters each weekend and “we’re doing the full grassroots outreach.” He expressed confidence that the measure will be defeated: “Folks have been well educated on this issue.”

Arnst estimates that this will be a historically low turnout election: “Top end right now, comparing the last three presidential primaries, I’m looking at 40 percent as the top turnout possible.”

But you know what that means, right? Your vote could be more decisive than ever, particularly for the 24 members of the DCCC, the outcome of which could move the ideological center of that body before its important endorsements in the fall Board of Supervisors races. To their credit, Sups.Elsbernd and Malia Cohen responded, Sup. David Chiu said he could not make the deadline but would reply with a new deadline.  Sups.Wiener and Farrell and Carmen Chiu have not responded.

Dear Bruce –
It was nice to see you the other night at the Potrero Hill Boosters dinner. I believe very strongly in the Sunshine Ordinance, transparency and efficiency in government. I also believe that the Sunshine Ordinance Task Force is an essential component of ensuring that our City departments are open with members of the public. As I mentioned in my comments on Tuesday, I have significant concerns with opinions of some of the Task Force’s members that the City Charter does not apply to them in the same manner as it applies to all other elected and appointed bodies in the City. I also have concerns about the inefficiency of Task Force meetings and the process by which complaints are adjudicated. I was encouraged by the qualifications of a number of new applicants that applied to serve on the Task Force. In particular I believe that the newly appointed members bring a diverse skill set in consumer advocacy, media relations and community involvement in governmental issues. It has also been one of my commitments as a member of the Board of Supervisors to increase the diversity of the membership of our City’s appointed bodies, whether that be on the Small Business Commission, Entertainment Commission or the Sunshine Ordinance Task Force, and I believe that the new appointees bring a much needed level of diversity to this body. I also want to stress that we still have a number of seats that the Rules Committee has not yet recommended appointments to. I know that it is my intention and I would also bet that it is the intention of my colleagues to ensure that these remaining vacant seats meet the requirement to have a physically handicapped individual on the Task Force, as well as individuals who bring expertise and experience in the above mentioned areas.

B3 note: Here are responses from City Attorney Dennis Herrera to Impertinent Questions from B3 on why the city attorney helped facilitate the supervisorial attack on the sunshine ordinance and task force (See previous B3 sunshine blogs).

Regarding recommended SOTF candidates

Section 67.30 (a) of the San Francisco Sunshine Ordinance provides that the Sunshine Ordinance Task Force’s eleven voting members be “appointed by the Board of Supervisors.”  That same section designates that a total of four members be appointed by the Board from names submitted for consideration by: the local chapter of the Society of Professional Journalists; the League of Women Voters; and New California Media.  I’m informed that when the Board’s Rules Committee conducted its hearing and interviewed SOTF applicants, only one person was recommended for each seat by these entities.  The Rules Committee then continued action on those seats until the entities submitted additional names.  Legally, there is nothing problematic about such a continuance.

Regarding designated seats

Section 67.30 (a) includes specific designations for each of the seats on the SOTF.  It additionally provides that one of those seats be a person with a disability, although it does not prescribe which of the 11 seats be designated to a person with a disability.  I’ll be honest here: I’m not aware of whether Mr. Todd has a disability or not.  But given that the Board still has to fill four remaining vacant SOTF seats, it will comply with the Sunshine Ordinance so long as one of the SOTF seats is timely filled by “a member of the public who is physically handicapped and who has demonstrated interest in citizen access and participation in local government.”

Regarding public comment

Public comment occurs in board committees.  Each SOTF applicant spoke at the Rules Committee, and members of the public had the opportunity there to offer their comments on all of the applicants.  Although the Rules Committee forwarded six recommendations out of committee, the record transmitted to the full Board included the entire file — including all the other applicants.  The City Attorney’s Office has long advised the Board of its authority to amend appointing motions, and to instead appoint someone else, so long as that appointee’s name and application was before the Rules committee, and so long as it was subject to public comment.  That was indeed the case here.  At the committee level, applicants speak; members of the public speak about the applicants; and then public comment is closed.  The committee then decides on its recommended appointments — but public comment is not reopened to comment on the committee’s choices.  

Regarding the role of the City Attorney

With respect to your question about why the City Attorney is “allowing” certain actions by clients, I should briefly address the role of the City Attorney under San Francisco Charter § 6.102.  Beyond the particular set of circumstances addressed in this email, most questions about what the City Attorney “allows” or “disallows” really misinterpret the office’s function.  In many contexts over many years, the office has reiterated that “[t]he City Attorney is not a policy maker.”  (See: http://www.sfcityattorney.org/modules/showdocument.aspx?documentid=953 )  The City Attorney’s Good Government Guide (pages 19-21) addresses at length the role the City Attorney plays in providing legal counsel to the City and its elected officers, commissions and employees (See: http://www.sfcityattorney.org/Modules/ShowDocument.aspx?documentid=686 )  

This office provides legal advice to clients, while also acknowledging that the policy-making authority of the Board and Mayor includes the prerogative to assess for itself the relative legal risks of its actions, understanding that this office will defend its actions “so long as there are legally tenable arguments to support doing so.”  In that sense, the role is no different from that of any lawyer providing advice to a client: attorneys counsel; but clients, ultimately, decide.

B3 comment: The city attorney has made the case for the task force to get independent legal advice and to bring in an independent attorney to represent the task force. More: It is yet another reason to have an independent attorney as a task force member who is strong enough to go up against the city attorney as appropriate on critical issues.   This was the original reason for SPJ, with its experience in public access and First Amendment issues and litigation, to nominate an experienced attorney. This was the first time the supervisors rejected the SPJ nominee (and nominees from other organizations as mandated by the charter)  without a proper explanation or apology or a nice word of thanks. .He helped Willie Brownism prevail for the first time with the sunshine ordinance and task force.

And so the San Francisco supervisors ramped up their war on sunshine on Tuesday (May 22) when they rejected five qualified candidates for the sunshine task force and substituted five in experienced in candidates with no experience or visible qualifications.

The key vote was to reject Bruce Wolfe, an experienced task force member, and substitute Todd David, a self-employed investor whose application for the task force said he had never attended a task force meeting and left blank the statement of his qualifications. Housing and highrise offices

EDITORIAL It's something of a civic shame that the only way San Francisco can build a new transit terminal is to sell a private developer the rights to stick a 1,070-foot highrise office tower on public land. In fact, it's a sad statement on the city, state, and local government: Once upon a time — and it wasn't the long ago — tax dollars collected through a progressive system paid for major infrastructure projects.

But there's no easy way to raise $4 billion in tax money for the Transbay Terminal — even though it ought to be seen as part of the high-speed rail project, and the federal and state government ought to be picking up the tab. So San Francisco ambles forward, selling land and lease rights to the highest bidder.

In this case, Gerald Hines of Houston won the right to build the largest highrise west of the Mississippi on property owned by the Transbay Joint Powers Authority. There are all sorts of drawbacks to the deal — among other things, it will cast shadows on a number of city parks, all the way to Portsmouth Square in Chinatown. Like any massive office complex, it will put pressure on Muni, on city streets, on police and fire and other city services — and no commercial office building ever pays its fair share of that burden. And since in this case the major recipient of the money from the project will be the TJPA, the city's General Fund will suffer.

Oh, and the building is ugly.

Meanwhile, city planners want to increase height limits all around the Transbay Terminal and allow hundreds of units of new (luxury) housing and more commercial office space. It's going to be a new highrise neighborhood, complete with a rooftop park and a few little patches of ground-level open space, which won't get a whole lot of sun, particularly in the morning and evening.

And at this point, there's been very little focus on what ought to be the defining issue of this and the other major developments on the city's planning horizon, and that's affordable housing.

This city has a terrible jobs-housing mix. The vast majority of the people who currently work in San Francisco can't afford to buy a house here, and many of them can only rent if they pay for more than the federal standard of one-third of their income for housing. So people who work in hotels and restaurants and city, state and federal offices and hospitals and even financial district companies wind up living far from the city and commuting. Nobody thinks that's a sound environmental policy.

And this kind of full-scale rezoning and development will only make it worse. According to the City Planning Department, the Hines project will pay about $27 million into the city's affordable housing fund, enough to pay for maybe 60 or 70 housing units. That won't even begin to cover the need created by the thousands of employees who will fill that tower. The market-rate housing on the site will almost certainly be beyond the reach of most San Franciscans, and probably many of the office workers who fill the Hines building. And only 35 percent of the new housing — at maximum — will be affordable.

San Francisco has to get a grip. The city can't keep allowing more high-end housing and highrise office space without a plan to meet its housing needs. We're glad to see the mayor talking about a $50 million a year fund, but that will barely meet existing needs; it can't possible keep pace with new development.

So before the supervisors rush ahead to approve this ambitious new downtown district, they need to ask Hines, and the TJPA, and any other developer who comes along, how it intends to meet the demonstrated need for affordable housing that these projects will create — and demand a much higher level of payment that what's currently on the city's books.

Sunshine eclipsed

As an advocate for the passage of the San Francisco Sunshine Ordinance in the early 1990s, I felt obligated to take my first and only City Hall position and serve as a founding member of the Sunshine Ordinance Task Force. I served for l0 years and helped with many other good members to build the task force into a strong and respected agency for helping citizens get access to records and meetings and hold city officials accountable for suppressing access and information.

The task force is the first and best local sunshine task force of its kind in the country, if not the world. It is the only place where citizens can file an access complaint without an attorney or a fee and force a city official, including the mayor, to come before the task force for questioning and a ruling on whether they had violated sunshine laws. The task force lacked enforcement powers, but it still annoyed city officials, including Mayor Willie Brown.

In fact, Brown spent a good deal of time trying to kick me off the task force. He used one jolly maneuver after another, even getting an agent to make a phony complaint against me for violating the ordinance with an email (The complaint went nowhere). I refused to budge and decided to stay on until Brown left office—on the principle that neither the mayor nor anybody else from City Hall could arbitrarily kick members off the task force.

That principle held until about 3pm last Thursday (May 17) at the meeting of the Board of Supervisors Rules Committee to appoint candidates to the task force. At that meeting, without proper notice, advance warning, explanation, apology, or even a nice word or two, the supervisors suddenly turned a normal drowsy committee meeting into an unprecedented bloodbath for the task force and its independence. Sup. Mark Farrell played the heavy, Jane Kim was the facilitating chair, and David Campos was the reluctant third party, working together to bring Willie Brownism back at the task force with a vengeance.

The committee rejected four qualified candidates from three organizations who are mandated by the Sunshine Ordinance to choose representatives for the task force because of the organizations’ special open government credentials. (Doug Comstock, editor of the West of Twin Peaks Observer; Attorney Ben Rosenfeld from the Northern California chapter of Society of Professional Journalists, sponsor of the ordinance; Allyson Washburn from the League of Women Voters and Suzanne Manneh from America New Media.)

The committee without blushing asked the organizations to come up with a “list of names,” a whiff of grapeshot aimed at members and organizations who had served the public well for years. Who wants to go before the supervisors on a list of names for a bout of public character assassination? Meanwhile, while knocking off the qualified, knowledgeable candidates, the committee approved four neophytes without experience and then unanimously appointed David Pilpel, a former task force member known for delaying meetings with bursts of nitpicking. He almost always comes down on the side of City Hall and against citizens with their complaints.

Farrell also tried to bounce Bruce Wolfe, an excellent member, but Kim and Campos supported him and his name was sent on to the full board for approval.

Then, when Wolfe’s name got to the board on May 22, it was a repeat of Willie Brownism and this time to the max. Sup. Scott Wiener moved to amend the motion and substituted Todd David. Farrell seconded. The vote was 6-5, meaning that Willie Brownism wiped the sunshine slate clean of anybody who would raise a pesky question of city officials and the City Attorney’s Office.

The infamous votes against Wolfe: Wiener (ah, yes, the heir of the Harvey Milk and Harry Britt seat in the Castro), Farrell (where is Janet Reilly when we need her?), Malia Cohen (who comes from the Potrero Hill/Bay View/Hunters Point district that needs all the sunshine it can get in facing an Oklahoma-style land rush of development), David Chiu (who was reportedly angry over the unanimous task force opinion finding he violated the Sunshine Ordinance with late submission of documents before the controversial vote to redevelop Parkmerced), Carmen Chu and Sean Elsbernd (neighborhood supes way out in West Portal and the Sunset who almost always vote the downtown line at City Hall). The good votes for Wolfe: John Avalos, Eric Mar, Cristina Olague, Jane Kim, and David Campos.

Campos told me that the organization candidates were “eminently qualified,” that they should have been appointed, and that he would fight for them. He advised the organizations to “stand by their candidates.” He is urging that the issue of organization candidates come back to the next Rules Committee.

Rick Knee, SPJ’s mandated journalist on the task force surveying the carnage, said the supervisors’ actions stem “partly from a desire by some supervisors to sabotage the task force and ordinance itself, and partly from a vendetta by certain supervisors after the task force found several months ago that the board violated local and state open meeting laws when it railroaded some last minute changes to a contract on the Parkmerced development project without allowing sufficient time for public review and comment.”

Knee is right, and it isn’t just Parkmerced, but all the high-stakes development deals flowing through City Hall these days, with their advocates preferring to cut backroom deals rather than being subjected to the full scrutiny of the public and the task force.

James Chaffee, a former chair of the task force, watched the board proceedings with outrage and fired off a letter to all supervisors later that day. He charged that the board in sacking Wolfe violated the Sunshine Ordinance on several counts. Among them: the board changed the committee recommendation on Wolfe without allowing public comment and it passed over Wolfe even though the ordinance requires at least one member of the task force to be “physically handicapped.” That was Wolfe.

Thus, Chaffee wrote, the orchestrated coup was “the perfect example of a failure to follow the sunshine ordinance that led to the sort of problem that it was intended to forestall, namely the supervisors taking an action without being informed of what they are doing.  If Scott Weiner and David Chiu and the rest of the crew did not consider the citizens the enemy and exercize judgment about whether they were complying with the spirit of open government rather than just shaving off the letter of the law as closely as possible, this could have been avoided.”

Chaffee said he couldn’t tell if David was physically handicapped but he said nothing in his application for the task force nor was any disability apparent from the video of the rules committee meeting.

Chaffee said David’s  application showed he  was “self-employed as an investor, obtained a BA from Stanford in 1993, has never attended a task force meeting, and left the statement of his qualifications blank.”

Chaffee said, “It’s easy to see why Scott Wiener likes him. He said it would be a long road before he would go against the city attorney’s office and when it came to constitutional law, he would place the city attorney’s opinion above his own because the city attorney is an ‘expert.'”

Julian Davis announces for supervisor in the key battleground district for progressives (5)

Julian Davis, a widely known progressive activist and organizer in San Francisco since 2002, declared Tuesday  his intention to run for supervisor in District 5, the city’s most liberal district and a battleground district for progressives seeking to regain control of the Board of Supervisors.

He joins eight other challengers to Sup. Christina Olague, appointed by Mayor Ed Lee to replace former Sup. Ross Mirkarimi. He was considered by many to be  the board’s most reliable progressive. He succeeded Matt Gonzales, a strong progressive.  The battle will center on which candidate will be the most reliable progressive vote–Olague,  whose votes are being carefully watched by progressives, or by one of her challengers.

Davis, a Bay Area native,  is a graduate of Brown University and UC Hastings College of the Law, where he graduated magna cum laude. He has worked in government and non-profit and legal sectors on community development, civil rights, social justice, public power, and environmental causes. He has worked on several candidate and ballot measure campaigns including John Avalos for mayor (20ll), Jane Kim for supervisor (2010), Prop H (2008), Clean Energy Act.) He also led a succeesful campaign in 2007 to free journalist Josh Wolf from federal prison for refusing to reveal sources in a demonstration he was covering.

“I was drawn to San Francisco by the creative energy and culture of the city–by what makes this place so special,” Davis said. “Over the past l0 years, I’ve devoted myself to developing healthy communities. The battle of 8 Washington

More than 100 people showed up May 15 to testify on a condominium development that involves only 134 units, but has become a symbol of the failure of San Francisco’s housing policy.

I didn’t count every single speaker, but it’s fair to say sentiment was about 2-1 against the 8 Washington project. Seniors, tenant advocates, and neighbors spoke of the excessive size and bulk of the complex, the precedent of upzoning the waterfront for the first time in half a century, the loss of the Golden Gateway Swim and Tennis Club — and, more important, the principle of using public land to build the most expensive condos in San Francisco history.

Ted Gullicksen, director of the San Francisco Tenants Union, calls it housing for the 1 percent, but it’s worse than that — it’s actually housing for the top half of the top half of the 1 percent, for the ultra-rich.

It is, even supervisors who voted in favor agreed, housing the city doesn’t need, catering to a population that doesn’t lack housing opportunities — and a project that puts the city even further out of compliance with its own affordable-housing goals.

And in the end, after more than seven hours of testimony, the board voted 8-3 in favor of the developer.

It was a defeat for progressive housing advocates and for Board President David Chiu — and it showed a schism on the board’s left flank that would have been unthinkable a few years ago. And it could also have significant implications for the fall supervisorial elections.

Sup. Jane Kim, usually an ally of Chiu, voted in favor of the project. Sup. Eric Mar, who almost always votes with the board’s left flank, supported it, too, as did Sup. Christina Olague, who is running for re-election in one of the city’s most progressive districts.

At the end of the night, only Sups. David Campos and John Avalos joined Chiu in attempting to derail 8 Washington.

The battle of 8 Washington isn’t over — the vote last week was to approve the environmental impact report and the conditional use permit, but the actual development agreement and rezoning of the site still requires board approval next month.

Both Mar and Olague said they were going to work with the developer to try to get the height and bulk of the 134-unit building reduced.

But a vote against the EIR or the CU would have killed the project, and the thumbs-up is a signal that opponents will have an upward struggle to change the minds of Olague, Kim, and Mar.

 

DEFINING VOTES

The 8 Washington project is one of a handful of defining votes that will happen over the next few months. The mayor’s proposal for a business tax reform that raises no new revenue, the budget, and the massive California Pacific Medical Center hospital project will force board members to take sides on controversial issues with heavy lobbying on both sides.

In fact, by some accounts, 8 Washington was a beneficiary of the much larger, more complicated — and frankly, more significant — CPMC development.

The building trades unions pushed furiously for 8 Washington, which isn’t surprising — the building trades tend to support almost anything that means jobs for their members and have often been in conflict with progressives over development. But the Hotel and Restaurant Employees Union joined the building trades and lined up the San Francisco Labor Council behind the deal.

And for progressive supervisors who are up for re-election and need union support — Olague and Mar, for example — defying the Labor Council on this one was tough. “Labor came out strong for this, and I respect that,” Olague told me. “That was a huge factor for me.”

She also said she’s not thrilled with the deal — “nobody’s jumping up and down. This was a hard one” — but she thinks she can get the developer to pay more fees, particularly for parking.

Kim isn’t facing re-election for another two years, and she told me her vote was all about the $11 million in affordable housing money that the developer will provide to the city. “I looked at the alternatives and I didn’t see anything that would provide any housing money at all,” she said. The money is enough to build perhaps 25 units of low- and moderate-income housing, and that’s a larger percentage than any other developer has offered, she said.

Which is true — although the available figures suggest that Simon Snellgrove, the lead project sponsor, could pay a lot more and still make a whopping profit. And the Council of Community Housing Organizations, which represents the city’s nonprofit affordable housing developers, didn’t support the deal and expressed serious reservations about it.

Several sources close to the lobbying effort told me that the message for the swing-vote supervisors was that labor wanted them to approve at least one of the two construction-job-creating developments. Opposing both CPMC and 8 Washington would have infuriated the unions, but by signing off on this one, the vulnerable supervisors might get a pass on turning down CMPC.

That’s an odd deal for labor, since CPMC is 10 times the size of 8 Washington and will involve far more jobs. But the nurses and operating engineers have been fighting with the health-care giant and there’s little chance that labor will close ranks behind the current hospital deal.

Labor excepted, the hearing was a classic of grassroots against astroturf. Some of the people who showed up and sat in the front row with pro-8 Washington stickers on later told us they had been paid $100 each to attend. Members of the San Francisco Planning and Urban Research Association, to which Snellgrove has donated substantial amounts of money in the past, showed up to promote the project.

 

BEHIND THE SCENES

But the real action was behind the scenes.

Among those pushing hard for the project were Chinese Chamber of Commerce consultant Rose Pak and community organizer David Ho.

Pak’s support comes after Snellgrove spent years courting the increasingly powerful Chinatown activist, who played a leading role in the effort that got Ed Lee into the Mayor’s Office. Snellgrove has traveled to China with her — and will no doubt be coughing up some money for Pak’s efforts to rebuild Chinese Hospital.

Ho was all over City Hall and was taking the point on the lobbying efforts. Right around midnight, when the final vote was approaching, he entered the board chamber and followed one of Kim’s aides, Matthias Mormino, to the rail where Mormino delivered some documents to the supervisor. Several people who observed the incident told us Ho appeared to be talking Kim in an animated fashion.

Kim told me she didn’t actually speak to Ho at that point, although she’d talked to him at other times about the project, and that “nothing he could have said would have changed anything I did at that point anyway.” Matier and Ross in the San Francisco Chronicle reported that Ho was heard outside afterward saying “don’t worry, she’s fine.”

Matier and Ross have twice mentioned that the project will benefit “Chinatown nonprofits,” but there’s nothing in any public development document to support that assertion.

Chiu told me that no Chinese community leaders called him to urge support for 8 Washington. The money that goes into the affordable housing fund could go to the Chinatown Community Development Corp., where Ho works, but it’s hardly automatic — that money will go into a city fund and can’t be earmarked for any neighborhood or organization.

CCDC director Norman Fong confirmed to me that CCDC wasn’t supporting the project. In fact, Cindy Wu, a CCDC staffer who serves on the city Planning Commission, voted against 8 Washington.

I couldn’t reach Ho to ask why he was working so hard on this deal. But one longtime political insider had a suggestion: “Sometimes it’s not about money, it’s about power. And if you want to have power, you need to win and prove you can win.”

Snellgrove will be sitting pretty if 8 Washington breaks ground. Since it’s a private deal (albeit in part on Port of San Francisco land) there’s no public record of how much money the developer stands to make. But Chiu pointed out during the meeting, and confirmed to me later by phone, that “there are only two data points we know.” One is that Snellgrow informed the Port that he expects to gross $470 million in revenue from selling the condos. The other is that construction costs are expected to come in at about $177 million. Even assuming $25 million in legal and other soft costs, that’s a huge profit margin.

And it suggests the he can well afford either to lower the heights — or, more important, to give the city a much sweeter benefits package. The affordable housing component could be tripled or quadrupled and Snellgrove’s development group would still realize far more return that even the most aggressive lenders demand.

Chiu said he’s disappointed but will continue working to improve the project. “While I was disappointed in the votes,” he said, “many of my colleagues expressed concerns about height, parking, and affordable housing fees that they can address in the upcoming project approvals.”

So what does this mean for the fall elections? It may not be a huge deal — the symbolism of 8 Washington is powerful, but if it’s built, it won’t, by itself, directly change the lives of people in Olague’s District 5 or Mar’s District 1. Certainly the vote on CPMC will have a larger, more lasting impact on the city. Labor’s support for Mar could be a huge factor, and his willingness to break with other progressives to give the building trades a favor could help him with money and organizing efforts. On the other hand, some of Olague’s opponents will use this to differentiate themselves from the incumbent. John Rizzo, who has been running in D5 for almost a year now, told me he strongly opposed 8 Washington. “It’s a clear-cut issue for me, the wrong project and a bad deal for the city.” London Breed, a challenger who is more conservative, told us: “I would not have supported this project,” she said, arguing that the zoning changes set a bad precedent for the waterfront. “There are so many reasons why it shouldn’t have happened,” she said. And while Mar is in a more centrist district, support from the left was critical in his last grassroots campaign. This won’t cost him votes against a more conservative opponent — but if it costs him enthusiasm, that could be just as bad.
