The battle for BART board

The race for BART board of directors in the upcoming November election has been highly contested this year. As we previously reported, incumbent James Fang faces a challenge from investor and former solar company entrepreneur Nicholas Josefowitz, a Harvard graduate in his early 30s.

Here’s your opportunity to listen in on the Bay Guardian endorsement interviews with candidates running for BART board. Alongside our colleagues from down the hall at the San Francisco Examiner (check out the Examiner’s endorsements here – they’re rather similar to ours), we spent a couple weeks interviewing candidates running for office in local and statewide races.

As we explain in our Endorsements issue, which hit newsstands yesterday, we decided to go with Josefowitz. It was a surprisingly tough choice, given how long we’ve been wanting someone to make a strong and well-funded challenge to Fang, San Francisco’s only Republican elected office holder and the longest serving director at an agency that has been hostile to worker safety reforms and meaningful oversight of the BART Police Department.

We got our wish when Josefowitz entered the race, did well in fundraising, and got lots of progressive political support. But SEIU Local 1021 strongly supported Fang, who walked the picket lines with striking BART workers last year. They and other Fang allies also highlighted Josefowitz’s opposition to CleanPowerSF and Prop. G, raising questions about his progressive credentials and political naïveté.

Fang deserves credit for supporting BART workers last year and with advocating for a BART extension to Ocean Beach. But the BART board needs new blood, and we believe Josefowitz has the energy, ideas, and perspective to move the district in a more sustainable, accountable, and innovative direction.

SEIU Local 1021 backs motorist measure and a Republican. WTF?!?!

Service Employees International Union Local 1021 — which has long played an important role in San Francisco’s progressive movement, providing the money and member turnout to achieve some important victories for the left — finds itself at odds with many progressive activists in this election, particularly on the issue of transportation.

As we previously reported, the union has been aggressively campaigning for BART Board member James Fang’s reelection this year, even though Fang is the city’s only elected Republican and not particularly progressive on transit and other issues. But he was the only BART board member to walk the picket line with the workers during last year’s disastrous strikes, so it’s understandable why the union would stand with him now.

What’s less understandable is why Local 1021 has endorsed the Yes of Prop. L campaign, which seeks to undermine San Francisco’s transit-first policies and transfer money from Muni operations to subsidize more free public parking for automobiles, joining such unlikely allies as the San Francisco Republican Party, the SF Association of Realtors, and the SF Chamber of Commerce.

So we asked Local 1021 Political Chair Alysabeth Alexander about the endorsement, and she told us: “One of our member leaders is a proponent and the argument that driving is hell in San Francisco resonated with a portion of our membership that drives and for whom public transportation is not an option either because of service cuts and route changes, because their job requires car use, or because they work shifts that don’t work for public transportation or biking. Because of rising housing prices many working people have been pushed out of SF over the years, and many of our workers shifts end or start when BART or Muni isn’t working or isn’t practical. Our union is 100 percent supportive of public transportation and addressing the climate crisis head-on.  We are fighting for the expansion of public transportation and for adequate funding, and sufficient staffing so that it can be maintained.”

The “member leader” she referred to was apparently Claire Zvanski, a longtime past president of the District 11 Democratic Club. But even that club couldn’t bring itself to endorse this myopic primal scream of a ballot measure, taking no position and writing, “This is a policy statement to inform the MTA that cars and those who love them are not getting enough attention in the transit planning process. This measure received a No Recommendation as an alternative to an Oppose from the eboard, mostly out of respect for our venerable past-president Claire Zvanski. The members also voted No Recommendation.”

Most progressive and transportation-related groups are opposing Prop. L, which its opponents say will actually make things worse for motorists in the city by undermining current efforts to make Muni more attractive and encourage people to use alternatives to the automobile.

“If we don’t reduce the congestion on the streets, that makes it harder for the people who really do have to drive,” No on L campaign manager Peter Lauterborn told us, responding to Alexander’s argument that the measure somehow helps working people and noting that Local 1021 never allowed the No on L campaign to make its case before endorsing the measure [UPDATE/CLARIFICATION: Alexander said the San Francisco Bicycle Coalition “did present a No on L position]. He also said the measure may have visceral appeal to frustrated drivers, but it doesn’t really make sense.

“Taking away money from the transportation system to build parking garages doesn’t help anyone,” Lauterborn said. “The Labor Council endorsed No on L and the reality is working class people use Muni at a far higher percentage than those citywide….Being pro-transit is inconsistent with supporting a ballot measure that would defund Muni.”

Meanwhile, in an allegedly unrelated matter, Local 1021 Political Director Chris Daly — who was a local leader of the progressive movement while serving the Board of Supervisors 2000-2010 — on Friday resigned from the union, where the Guardian has long been aware that he was having internal power struggles over the last year.

Daly tells us that his departure wasn’t based on political or philosophical differences with SEIU, that he’s proud of the work that he and his colleagues have done on wage equity and beating back anti-worker threats, and that it just seemed like the right time to leave, although he’s not sure what he’ll do next.

“I’m sorry to go,” he told us, “but it was time to go.”

Money for Muni

STREET FIGHT San Francisco’s November ballot is crowded. With 12 local measures and seven state measures, sifting through them can be daunting. Three local measures, Propositions A, B, and L, involve transportation and have great bearing on the city’s future.

Not to belittle the other ballot measures, some of which address critical health and housing problems, these three transit-related measures say a lot of how the city is addressing — and failing to address — the need for a sustainable transportation system.

 

TRANSPORTATION BOND

Prop. A is the most important of the three transportation measures on the ballot, but also the most difficult to pass because it requires approval from two-thirds of voters.

It would provide $500 million for Muni, street repaving, and pedestrian and bicycle safety projects. That’s a modest sum compared to the $10 billion the city should really be spending, but it would help make 15 of the city’s busiest transit routes 20 percent faster and more reliable.

Portions of the funds would go to modernizing Muni’s maintenance shops, which need upgraded ventilation, fueling, and washing facilities and to new elevators and passenger platforms to make Muni more accessible to the elderly and disabled. Prop. A’s campaign also touts $142 million going towards pedestrian, bicycle, and motorist safety in corridors where the most death and injury have occurred.

Prop. A should really be thought of as two parts, one good, one not so good. The first part involves up to $55 million in annual revenue coming from property assessments. Since Prop. A simply replaces retiring city debt, it does not raise property taxes, but rather it sustains existing rates.

This links property values to what makes property valuable in the first place — public investment in infrastructure. As long as Prop. A is used for those 15 Muni corridors and safer streets, it is sound public policy.

The second part of Prop. A involves bonds, or borrowing money and paying interest to financiers. This is a long-used method of infrastructure finance, and was in fact how Muni got started in 1909 when voters approved creating public transit. The taxation will pay off the capital debt.

But bonds are a funding scheme that involves interest and fees that go to Wall Street — not the most progressive approach to infrastructure finance. While no one can say for sure, some critics suggest up to $350 million in debt would be incurred over the life of the bond scheme, which means Prop. A is really an $850 million package.

Ultimately, this is a regressive approach to transport finance and needs to be replaced by a more pay-as-you-go approach.

We are stuck between a rock and a hard place on Prop. A. Floating this bond now would bring in money very quickly, improving everyone’s commute, especially lower- and middle-income transit passengers. If approved it will also leverage state and federal matching funds, such as new cap-and-trade funding, hastening shovel-ready projects that many San Franciscans are clamoring to get done.

Getting transportation projects going now is less expensive than waiting while construction costs climb. Prop. A funds vitally important transportation infrastructure projects and it deserves support.

 

GROWTH AND MUNI

While Prop. A deals with streets and capital projects for Muni, it can’t be used to fund acquisition of new vehicles or Muni operations. This is where Prop. B comes in because it specifically involves an annual set-aside of about $22 million from the city’s General Fund to provide new vehicles and operating funds.

Prop. B is a well-intentioned linkage of population growth to transit capacity. The money goes towards Muni capacity expansion, based on population growth over the past decade, would increase with population growth in future years, about $1.5 million per year based on past trends.

There’s no doubt that transportation is failing to keep up with San Francisco’s boom. New housing and offices are coming into neighborhoods where buses are already jam-packed and streets saturated with traffic. But there are a couple of problems with Prop. B.

First, Prop. B is promised as a short-term measure because the mayor can end this general fund set-aside if a local increase in the vehicle license fee is approved by voters in 2016. The VLF, which was gutted by Gov. Arnold Schwarzenegger in 2003, would bring in about $75 million to the city annually.

That the mayor would voluntarily (and it is the mayor’s discretion) sunset B in two years is a big “if” and voters are notoriously forgetful.

In the meantime, Prop. B does not come with a revenue source to account for this increasing set-aside for Muni, so something else in the General Fund must give. What that would be, nobody can say, but advocates for social service and affordable housing fear more vulnerable San Franciscans will be hurt in the 2015 city budget.

Given the incredibly slow city response to the gentrification and displacement crisis, their fears may be warranted.

 

GLOOMY REALITY

My hesitation about Prop. B and tepid support for Prop. A stem from a gloomy reality in San Francisco’s politics of mobility. Today, it is easier for politicians to raise transit fares on the working poor, divert funds from social services and housing, or incur massive debt through bonds than it is to raise taxes on downtown commercial real estate and charge wealthier motorists for their detrimental impact to the city and society — both of which would be fairer ways to finance transportation.

Twenty years ago, it was estimated that a modest tax assessment on downtown offices and their impact to the transportation system would bring in $54 million a year. Today, that would likely be well over $100 million annually. But with land-owning elites and tech barons calling the shots in City Hall, there is a de facto gag order on what would be the most progressive approach to Muni finance.

Meanwhile, had Mayor Ed Lee not pandered to wealthier motorists, Sunday metering would be providing millions annually in Muni operating fees. Sup. Scott Wiener, the author of Prop. B, and his colleagues on the board, were shamefully silent about blowing that $10 million hole in Muni’s budget. They were also silent or complicit in stopping expansion of SF Park, which is smart management of our streets and would provide millions more in operations funding for Muni without needing to dip into the city General Fund to plug gaps.

Meanwhile, congestion pricing — or charging drivers to access the most traffic-snarled portions of the city during peak hours — could bring in up to $80 million annually. Together with a reestablished VLF, that would simultaneously erase the need to do Prop. B and reduce our need to incur more wasteful debt.

Instead of bonds, Prop. A’s $55 million could be coupled with an annual downtown property assessment, an annual VLF, a congestion charging zone, and revenue from an expanded SF Park, the city could borrow less, manage traffic wisely, and keep transit capacity at pace with population growth. We could avoid raiding the General Fund to subsidize Muni operations and could reduce debt simultaneously.

Transit advocates are right to cry foul when other revenue sources have been removed from consideration, mostly because of gutless reluctance to challenge wealthy landowners and motorists. This is the crux of why transit advocates, backed into a corner by Mayor Lee’s repeal of Sunday meters and the VLF, are supporting Prop. B. The “B” in Prop. B basically stands for backfilling broken promises.

But ultimately, all of the supervisors, including Wiener, are complicit in the mayor’s mess. Why didn’t the supervisors speak up when Sunday metering was repealed? Why didn’t the supervisors insist on placing the VLF on this year’s ballot? With a two-thirds vote of the board, it would be on the ballot now. And unlike Prop. A, the VLF only needs a simple majority to pass.

And now, because the mayor and supervisors have pandered to motorists to the umpteenth degree, a small group of them feel even more emboldened and entitled to grab more. That takes us to Prop. L.

 

TRANSIT-LAST

Prop. L, which seeks to reorder transportation priorities in San Francisco, is awful. It comes from an angry, spiteful, ill-informed, knee-jerk lack of understanding of the benefits of parking management (which makes parking easier and more sensible for drivers). It is a purely emotional backlash that seeks to tap into anyone angry about getting a parking ticket.

Although a nonbinding policy statement, the basic demand of Prop. L is that the city change transportation priorities to a regressive cars-first orientation. It calls for freezing parking meter rates for five years while also using parking revenue to build more parking garages. The costs of these garages would dwarf parking revenue, and these pro-car zealots don’t say where these garages would be built, or that it would ultimately siphon more money from Muni.

Prop. L demands “smoother flowing streets,” which is a deceitful way of saying that buses, bikes, and pedestrians need to get out of the way of speeding car drivers who believe they are entitled to cross the city fast as they want and park for free. It conjures up a fantasy orgy of cars and freeways long ago rejected as foolish and destructive to cities.

Proponents on this so-called Restore Transportation Balance initiative don’t really care about “transportation balance.” When you consider the origins and backers of Prop L, it’s mainly well-to-do motorists with a conservative ideology about the car. These are the very same people who have opposed bicycle lanes on Polk, Masonic, Oak, and Fell streets, and throughout the city.

These are the very same people who decried expansion of SF Park, thus making it harder, to find parking, not easier. These are the same people who complain about Muni but offer zero ideas about how to make it better. These disparate reactionaries have banded together around their animosity toward cyclists and Muni.

In the 1950s, when the love affair with cars was on the rise, San Francisco had about 5,000 motor vehicles per square mile. To accommodate more cars, planners required all new housing to have parking, made it easy to deface Victorians to insert garages, and proposed a massive freeway system that would have eviscerated much of the city.

Thankfully, neighborhood and environmental activists fended off most of the freeways, but San Franciscans failed to really take on the car. So by 1970, despite the freeway revolts and commitment to BART, automobile density rose to over 6,000 cars per square mile.

By 1990, San Francisco had almost 7,000 motor vehicles per square mile, even as population leveled off.

The current density of cars and trucks — now approaching 10,000 per square mile — is one of the highest in the nation and in the world. To put that into context, Los Angeles has less than 4,000 cars per square mile, and Houston less than 2,000 per square mile, but these are largely unwalkable cities with notorious environmental problems.

Do San Franciscans want to tear apart their beautiful city to be able to drive and park like Houstonians?

If proponents of Prop. L were truthful about “restoring balance” they would instead advocate a return to the car density of the 1950s, when San Francisco had just under 5,000 motor vehicles per square mile, Muni was more stable due to fairer taxes, and many of the streets in the city had yet to be widened, their sidewalks yet to be cut back.

Prop. L is tantamount to hammering square pegs into round holes. Jamming more cars into San Francisco would be a disaster for everyone. Don’t be misled, Prop. L would make the city too dumb to move. It would deepen and confuse already vitriolic political fissures on our streets and it would do nothing to make it easier to drive or park, despite its intention.

Prop. L must not only lose at the ballot, it must lose big, so that maybe our politicians will get the message that we want a sustainable, equitable, and transit-first city.

Changing the climate in SF

EDITORIAL As hundreds of thousands of people filled the streets of New York City and other cities around the world for a Global Climate Convergence on Sept. 21, demanding that our political and business leaders finally get serious about global warming (see “Flooding the streets“), there was no such gathering in San Francisco.

Sure, there were a few thousand Bay Area activists who gathered for the climate change event along Lake Merritt in Oakland, which included many groups and individuals from San Francisco. But we found it telling symbolism that San Francisco, as a city, was absent from this important political moment.

A city that was once a trailblazing leader on environmental issues such as solid waste reduction, transit-first policies, and adopting the precautionary principle — which calls on city officials to avoid policies and purchases that have the potential to cause environmental harm — has instead become a city guided by the logic and imperatives of capitalism, eager to grow and consume at any cost.

Speaker after speaker in New York City, Oakland, and other cities called for humanity to wake up to the realities of global climate change, slow down the wasteful economic churn and rapid depletion of important natural resources, and pursue fundamental changes to the system.

But in San Francisco, we appear to be headed in the opposite direction. The Mayor’s Office unceremoniously killed CleanPowerSF, the city’s only plan for offering more renewable energy to city residents. And it has pandered to motorists in ways that have taken millions of dollars away from public transit (see “Money for Muni“), encouraging more driving in the process even though we know that adds to global warming.

It isn’t just the neoliberals in City Hall, but the entire institutional structure of the city. Even SEIU Local 1021, long a stalwart supporter of progressive causes, has strangely endorsed the pro-automobile Prop. L and is aggressively supporting BART Board member James Fang, a Republican who supports costly extensions of the system rather than projects that promote more intensive transit uses in the urban core.

Finally, there’s this city’s monomaniacal promotion of the energy-intensive technology industry. Americans emit more greenhouse gases per capita than anyone, and recent reports show that reality is compounded by massive increases in China’s greenhouse gas emissions — which is partly because Bay Area companies produce their tech gadgets and other toys in China, which we then consume here.

San Franciscans need to stop being such voracious consumers and strive to be true innovators who accept our responsibilities and work to disrupt the rapid descent into a dangerously warming world.

 

Reform BART’s approach to labor

OPINION If BART is part of your daily commute, you know how critical a reliable system is to Bay Area working people. If you don’t ride BART, all you have to do it think about all the cars that the system keeps off the road every day.

That’s why everyone — most of all the BART unions and their supporters — found last year’s strike so upsetting. And now, a new report commissioned in part by BART Board member James Fang shows how unnecessary it was for management to drive workers to walk off the job.

In fact, the report says, hiring a union-busting outside negotiator was a serious mistake. Allowing that hired gun to pursue an extremist bargaining strategy was a major cause of the labor unrest.

The report, conducted by an outside consultant, involved interviews with dozens of workers, managers, and negotiators. The document is riddled with references to war: Bomb-throwing, Vietnam, a labor “massacre.” It shows how badly the executive management at BART allowed the climate for negotiations to deteriorate — and how hard it will be to repair the damage.

Here’s how one manager put it: “This strike was not productive. We never did a course correction and then there was another strike. Two people got killed. We spent millions to end up getting creamed, and engendering hate.”

The report notes how BART executive management and their notorious chief negotiator refused to take seriously the concerns workers expressed about safety.

“Key points made about safety in bargaining sessions fell on deaf ears…because management thought the unions were just posturing and the unions thought the management was refusing to engage,” it states.

Safety concerns were a central part of the negotiations from the workers’ perspective, and by dismissing those concerns as a tactic, BART’s consultant not only made an agreement more difficult but gambled with the safety of workers and riders in order get concessions from workers.

Fang, head of the BART Board’s Labor Negotiation Review Committee, is asking that the board adopt the report’s recommendations to prevent this from happening again. These recommendations include more transparency around the agency’s finances, a much earlier start to negotiations — and if needed, bringing in mediators, not outside anti-union consultants.

Once the rest of our elected BART Board of Directors became more involved, management found a reasonable solution that both sides could live with. Why didn’t that happen at the beginning of negotiations?

That’s what the BART Board needs to be asking itself. A fair post-mortem puts much of the blame on management — a general manager who had little experience in labor negotiations and a board that failed to show leadership and independence.

Fang, who is the one board member who joined workers on the picket lines, says it’s time for management to change its approach. He’s calling for a strike-prevention plan that starts with honest, fair labor relations.

We’ve heard from some politicians looking to score easy points from frustrated riders that BART strikes ought to be banned. And it’s easy to imagine frustrated commuters, stuck far from work when the trains weren’t running, feeling sympathetic.

But if workers don’t have the right to strike, they are powerless to speak out against dangerous working conditions to a recalcitrant and, in this case, misdirected management. That leads to a more dangerous system for all of us.

Recognizing this, BART Board President Joel Keller just withdrew his suggestion that strikes be banned.

The much better approach for riders like me is to follow Fang’s prevention plan: Hold management accountable for its failures and to make sure that both sides can work together better in the future.

BART is a phenomenally successful system. Ridership has doubled in recent years, to 440,000 trips a day. With trained and experienced BART workers, the system’s on-time performance has risen to 95 percent. That’s not the result of some high-paid labor negotiator — it’s the work of a dedicated and hard-working staff.

If you ride BART every day, you deserve to know that the trains will be running, that you can count on the system to get you to work on time. Between now and 2017, when the next contract will be negotiated, the BART Board needs to learn from its past mistakes and find a different, more collaborative approach. Bridge the housing-Muni divide

EDITORIAL One the most frustrating political conflicts in San Francisco this election season is the schism between sustainable transportation activists and affordable housing advocates, a split that unnecessarily divides the progressive movement and one that has been cynically manipulated by the Mayor’s Office and its political allies.

We at the Bay Guardian haven’t yet decided what position we’ll take on Props. A and B — both of which would give more money to the San Francisco Municipal Transportation Agency for Muni and other transportation needs — or Prop. K, the affordable housing measure that was heavily watered down by the Mayor’s Office. Our endorsements come out Oct. 8.

But we can say that we’ve been concerned with how housing and transportations needs have been pitted against one another — and by the political tactics that are being used to create that false choice in the minds of voters, often by those who have a financial self-interest in making misleading arguments.

San Francisco needs more affordable housing, a robust public transit system, and fully funded social services if it is to remain an efficient, diverse, compassionate city. We need all of those things, now, before we experience even more impacts from the rapid growth now underway.

Mayor Ed Lee chose to break his promise to place a local vehicle license fee increase on the fall ballot, so Sup. Scott Wiener and others placed Prop. B on the ballot instead. It would tie the city’s General Fund contributions to Muni to city population growth, but it would also allow the mayor to end that subsidy if voters approve the VLF increase in a future election.

Several local journalists have reported on the carrots and sticks that members of the Mayor’s Office have used to try to sink Prop. B and maintain affordable housing advocates’ support for Prop. K (see “Mayoral meltdown,” Aug. 5), pitting transportation and housing activists against one another, either by accident or design.

But San Francisco can’t afford this false dichotomy, and it’s high time to finally have this discussion openly and honestly. So the next Bay Guardian Community Forum — on Oct. 9 from 6-8pm in the LGBT Center, 1800 Market Street — will focus on bridging this gap. We’ll be inviting key players on both sides and we hope that you, dear readers, will join us as well.

The same players in this city who are urging San Francisco to rapidly grow as an economic and population center are sabotaging the political alliances and funding mechanisms that we need to handle that growth. It’s time for a forthright, public discussion about the city’s many long-term needs and how to finance them.

 

Deadly gamble

As BART management and unions were locked in dysfunctional contract negotiations that would result in two strikes and two deaths last year, the district and the media scoffed at workers safety concerns and waged a media campaign demonizing the unions. Now, a new report commissioned by the district calls that strategy a horrible mistake.

The report from independent investigators Agreement Dynamics Inc., “Bay Area Rapid Transit Collective Bargaining Report and Recommendations,” reveals BART management perceived the Bay Area as anti-union. This guided its decision to hire Tom Hock as a contract negotiator and adopt a union-bashing public relations strategy that was then amplified by most local mainstream media outlets.

“In interviews, Tom Hock said he believed the strike would be very short and the unions would have to come back and reach an agreement,” the report, which was based on more than 200 hours of interviews of 60 BART employees, managers, and contractors, found. “He said media reports also heavily favored the management perspective.”

The San Francisco Chronicle and the San Jose Mercury News attacked BART’s workers in their news and editorial pages, stoking the flames of anger. “As to union claims that this is all about safety — how stupid do they think the public is?” the Merc opined in a July 2013 editorial. The Chronicle struck a similar tone in its Oct. 18 editorial, blaming workers and writing “the walkout is the height of irresponsibility.”

The unions warned management not to run the trains during the second strike, but those safety warnings went unheeded. A contract deal was reached only after two men working on the tracks during the strike, Laurence Daniels and Christopher Sheppard, were accidentally run down during what was later revealed as a replacement driver training exercise — warnings be damned.

“Some in management believed they had a good media strategy that put the public on their side,” the report found. Therefore, “the public was angry with the unions for demanding too much in their contracts.”

BART approved a contract from big-time public relations firm Singer Associates in April last year. Sam Singer and his firm are well-known for pulling the strings of local journalists and using scorched-earth tactics. As a result, articles highlighted riders woes and selected employee salaries while discounting safety and other concerns raised by workers.

But BART management and its board had longstanding CAL-OSHA violations, some of which were the subject of labor negotiations leading up to the strike. Notably, BART’s now-defunct “simple approval” policy, by which workers verbally notified management they would be working on the tracks, was one that both workers and state regulators long urged the district to change. The two deaths were linked to that controversial practice, which BART has since ended (see “Tragedy follows strike,” 10/23/13).

State regulators have fined BART for that fatal misjudgment and a final report from the National Transportation Safety Board is expected in the coming months. Only The Nation, East Bay Express, and Bay Guardian covered BART safety concerns with any depth or gravity before the two workers’ deaths. It’s hard to tell who led the dance — did the mainstream media embolden management, or did management lead on the media? Either way, safety was not a priority for BART managers during negotiations.

“Key points made about safety in bargaining sessions, as reported to us, fell on deaf ears,” the report’s authors noted. “Management thought the unions were just posturing, and the unions thought management was refusing to engage.”

The unions, the report found, “voiced frustration that they have raised these issues repeatedly, and management was not responsive…The ‘simple approval’ policy was seen as indicative of management’s unwillingness to deal with safety concerns until two workers were killed during the second strike in 2013.”

BART’s next contract negotiation is set for 2017. The transit agency has much work to do to repair its lingering culture of distrust, but so-called unbiased media need to cop to their anti-union slants. It took two deaths to show how relevant safety concerns really were.

Supervisor Mar calls for more bike access on Muni

With racks that can hold only two bikes on the front of most Muni buses, and no bike access on Muni’s light rail fleet, Sup. Eric Mar is calling on Muni to look at improving its bike-access. At today’s Board of Supervisors meeting, he called for a hearing to explore what can be done to address the problem.

We’re looking at expanding the capacity of Muni for those that ride their bikes,” Mar told the board.

Currently Muni vehicles can carry two bikes at the front of each vehicle on its racks, which Mar called inadequate. Notably, only folding bikes are allowed on any Muni vehicle, which means light-rail riding bicyclists are left in the dust, bike grips in hand. 

A hearing on increased bus-bike capacity is especially timely, as Gov. Jerry Brown just signed AB 2707 into law last Tuesday, allowing transit agencies to increase the bike rack capacity on some buses to three bikes, instead of two. Also, San Francisco is anticipating a new fleet of buses, Mar noted, which may be a ripe opportunity to increase bike access. 

We contacted the San Francisco Municipal Transit Agency for comment on the cost and feasibility of any such bike improvements, and spokesperson Paul Rose said the agency is in the process of gathering that data.

San Francisco Bicycle Coalition Executive Director Leah Shahum said this was a good step for the city to take, but one that’s taken years to come to fruition.

“We’re really thrilled to see Supervisor Mar on the forefront of bike access, but this is also not a new idea,” Shahum said. “This was laid out in our bike plan years ago. We’ve seen advances in this regionally with BART lifting its ban on bikes.” 

Caltrain has also grown its bike access in recent years. “It’s exciting to see San Francisco able to do the same,” Shahum said.

The bike plan really highlights the opportunity for bikes on light rail vehicles, she added. But she wants to encourage the SFMTA to consider less busy times, like weekends or off-peak hours to bend those rules.

“Consider a family going to the Beach Chalet or someone who wants to enjoy Sunday Streets on the weekend,” she said. “Weekends could be an ideal time, (for bikes on light rail), especially for families.”

We need to start with what San Francisco State University Professor and Bay Guardian columnist Jason Henderson calls automobility, the feeling where everyone feels they need to drive in the city,” Mar said. “We need to encourage people to walk bike or take transit.”

Mar’s office told the Guardian they’re anticipating the hearing would take place in November, after the frenzy of the upcoming election. 

Golden Gate Bridge strikes won’t effect commuters…yet

Golden Gate Bridge iron workers are on strike today [Tues/16], protesting retiree healthcare issues their union says were not addressed in 2012. Commuters will not be affected during the strike, however. Machinists Local 1414 made that choice consciously, its representative told us. 

The machinists purposefully made a decision to not impact services,” said Alex Tonisson, co-chair of the Golden Gate Bridge Labor Coalition. The coalition is comprised of the 13 various unions that work on the Golden Gate Bridge, all of whom negotiate with the district together. “We want the public to understand how serious things have gotten.” 

The strike started early this morning and is scheduled to end at 3:30pm. Though the strike is not directly related to current labor negotiations for health care with the district, at this point those negotiations could best be described as… rocky.

The sticking points are health care and living wages. The Golden Gate Bridge District, with a board with nine San Francisco representatives and members spanning the Bay Area, said the increases in health care costs are still competitive in the Bay Area.

The District has sought modest increases to the amount that Coalition employees have been contributing to their health benefits,” the Golden Gate Bridge District said, in a press statement. “District employees enjoy world class health benefits.”

But the unions noted that the cost of living in the Bay Area has skyrocketed. Housing prices are up, gas prices are up, everything is up. Though the district’s offer includes a 3 percent wage increase next year, and further increases in subsequent years, the new health care plan would cost 2 percent of workers’ wages, largely nullifying any increases. And the workers gave up much ground during the worst of the Great Recession.

We bargained significant concessions and changes,” in previous years, Tonisson told us. 

Strikes from the Golden Gate Bridge’s ferry workers could potentially impact thousands of Bay Area commuters. The labor coalition seemingly took lessons to heart from last year’s BART strike, when the public’s support of strikers waned in the face of nearly impossible commutes.

Tonisson didn’t directly comment on the BART strikes, but said “we’re definitely aware how any strike that shuts down the bridge or ferries impacts the lives of residents.”

To keep the commuting public aware of an impending strike, the coalition took out radio and newspaper ads, and passed out leaflets on ferry commutes. 

We’re hoping we don’t have to take further action,” Tonisson said. “We want them to understand it’s a possibility. The public should take that seriously.” 

It’s sexy time on this week’s Alternative Ink

No, it wasn’t just that we had sex on the brain after a beautiful weekend in the warm San Francisco sunshine (yes, it’s true). We were also plugging our upcoming annual Sex Issue and the shenanigans therein, including Joe’s foray into virtual reality sex and the debut of the Bay Guardian’s hot new sex columnist, Krissy Eliot, who will be exposing herself to y’all quite a bit this week. And we even offered some gratuitious digs at our corporate overlords, and that’s always fun and cathartic.

So give it a listen on this (ugh!) busy Monday morning, or whenever you can get around to it, and it’ll be like the weekend never ended.  

Bombshell BART report slams hiring of union-busting negotiator Tom Hock

Independent investigators analyzing BART’s recent turmultuous, rollercoaster-ride labor negotiations issued their report yesterday, concluding that last year’s pair of damaging strikes could and should been avoided. The opinions that the analysts collected from the unions, management, and BART’s Board of Directors covered a wide spectrum, but there were a couple of common themes. 

First, the strikes and the death of two BART workers who were killed on the tracks when BART management ran scab-run trains while the workers were on strike, were devastating to the district and its personnel.

“We just walked out of a war,” one anonymous BART employee (or manager) told the report authors. Other anonymous quotes follow a similar theme: “It was like Vietnam… Labor massacare… The bloodiest strike ever… He was our hired gun… They threw bombs.” 

The second thing everyone agreed on, from management to the unions, was that hiring union-buster labor consultant Tom Hock as a negotiator was a bad idea

I think a lot of the stakeholders involved and unions have identified that Tom Hock was the problem,” Tom Radulovich, a BART board director, told the Guardian. “This (report) validates my concerns. They talked to everybody.”

Agreement Dynamics Inc., who conducted the investigation on behalf of the BART board, did in-depth interviews with a multitude of BART union representatives, employees, managers, and labor negotiators. Through the report, Agreement Dynamics found a culture of distrust between labor and management that they described as entrenched and multi-generational. On top of that already potent powder-keg, Hock was hired as a negotiator. Seven board directors cast “aye” votes to hire Hock, including Radulovich. Directors Fang and Murray were absent from the room at the time of the vote.

According to the report, Hock came in with guns blazing. Mixing that attitude with what the report describes as BART General Manager Grace Crunican’s lack of experience in labor negotiations, and there was a perfect recipe for conflict. 

“When Tom Hock took over as chief negotiator, Grace had become hard line,” one source told Agreement Dynamics. “There wasn’t enough trust built… Tom Hock thought a strike was inevitable. I don’t know how we thought we could win. We did not even have the whole board supporting this.”

But despite the lack of groundswell support, Hock perpetuated a strategy to push the unions to strike, according to the source. 

“Tom pushed it to strike because Grace would not budge financially,” the source said. “So Tom said to Grace, ‘You will have to strike with your position.’ Management thought we could win the PR battle and the unions would cave. But the unions had politicians. The press can turn on a dime. They did and our strategy backfired.”

Two managers told Agreement Dynamics that lack of planning exacerbated this problem.

“We did not have a Plan B to prevent a strike,” one manager told the investigators. Another told them, “This strike was not productive. We never did a course correction and then there was another strike. Two people got killed. We spent millions to end up getting creamed, and engendering hate.”

In interviews with the investigators, Hock told them he believed the strike would be very short and the unions would “have to come back and reach an agreement” before management would have to give in. He based this on the Bay Area’s sentiment against the unions, the report wrote. He told investigators that media reports also heavily favored management’s perspective. (The report also outlines how management believed their ‘good strategy’ helped sway big media, like the San Francisco Chronicle, to take their side. Good job, guys.)

The negotiators were told by Hock that a number of factors led to the strike, as he tried to deflect blame. But the report’s analysis said “the conditions cited by Tom Hock (elected board, politically strong unions, ineperience in labor negotiations) have existed in prior negotiations when no strike resulted.” 

So Hock pushed the unions to strike, the same strike that led to two workers’ deaths, the report seemingly implies. But that was not his only misstep, according to the report. He also didn’t read the contract he signed off on.

After labor negotiations concluded, BART management brought celebrations to a screeching halt. For those that remember, a provision on family medical leave, section 4.8 of the labor contract, was disputed by BART management. They said they never signed that provision, which could cost BART upwards of $40 million in sick leave, if approved. 

BART management said it signed the provision due to a “clerical error,” which BART board director Zachary Mallet confirmed to the San Jose Mercury News. “The cause of this incident has been confirmed as a miscommunication-based clerical error during the write-up of a tentative agreement,” Mallet told the Merc. 

But Hock and district negotiators Paul Oversier and Rudy Medina all told Agreement Dynamics that they signed it without reading it. “If Tom Hock had read it before he signed it, 4.8 would not have happened,” one BART staff member told the investigators. 

But as much as Hock comes under fire in this report, the report also found that he came at a time of deep division between labor and management. The report shows a way out for that: leadership from the BART Board of Directors. Radulovich told the Guardian he agrees. The board must take the reins in righting the historic bad blood between all sides at BART. 

A lot of it is the culture of your organization,” he said. “When I was a baby BART director, [employees and management] were complaining about things that happened back in 1979. You do feel like you’re walking in on a fight going on long before you got there, and going on long after you leave.”

“That antagonism has been there from the beginning,” he told us. “The question I ask myself is: how can I change that?”

Tomorrow morning at a press conference at 9am, some of the BART board will present the report and talk about its findings. Maybe we’ll find those answers then. 

Joel Daniel Phillips illustrates the overlooked in ‘I Am Another Yourself’

Joel Daniel Phillips draws people. He draws them with charcoal and pencil and is known for his life-sized renderings of eccentric, seemingly homeless men and women he meets on the corner of Sixth and Mission Streets in San Francisco.

His debut solo show with Hashimoto Contemporary, “I Am Another Yourself,” opens Sat/6 (opening reception 6-9pm; the show runs through Sept. 27). I met up with Phillips to talk about his work and to see his 14 pieces in person.

As we hung out in his roomy studio in East Oakland, the BART train lumbering by every so often, Phillips’s towering life-sized pieces captured my awe and attention. The details he emphasizes in his work  whether it’s a wrinkled pant leg, a takeout container, lines on a face, or a waning pack of Newport Lights  illustrate the attitude and honesty of his subjects. 

“I think of [my work as] a bit like journalism in that the goal is for me to honestly understand something else or someone else and then show it to my audience,” Phillips says. 

Phillips moved to San Francisco three years ago. Not knowing a whole lot about the city, he accepted a live-work studio space on Sixth and Mission. Once he arrived in the neighborhood, he realized it was — well, different. So he started his own artistic exploration of the street corner, which involved approaching people he found particularly intriguing, asking if he could take their photographs, and creating life-sized drawings of them.

When considering whom to approach for a photo, Phillips looks for “people who carry their story on their face” or demonstrate their story in the way they dress. These types of people embody the honesty and vulnerability he aims to capture in his pieces. 

 “I’m fascinated with vulnerability,” Phillips says. “If I approach most people in the street and ask them, ‘Can I take your photograph? I’m an artist,’ they’ll stand in a certain way, pose in a certain way, and have a projected sense of how they want to be perceived. But this particular subset of society doesn’t do that. They allow me into a deeper sense of who they are.”

While people may look at Phillips’s work and assume his drawings are of homeless men and women, that’s not necessarily the case. “A lot of people assume they are all homeless, but I have no idea if any of them are homeless,” Phillips says. 

And he doesn’t care to ask his subjects about their living situations, either. “Part of the reason I isolate my subjects from their backgrounds is because I want to remove certain information,” Phillips says. “I want you to take each person out of context and see them as an individual, rather than place them in a certain box.”

A unifying attitude that links Phillips’ subjects seems to be that “these people are in a place, for whatever reason, where they don’t really give a shit. They’ve gone through a lot of things  maybe hard, maybe just different than your average suburban white kid’s experiences  that have put them in a place where they are comfortable,” Phillips says.

He describes his goal as building an emotional and mental bridge between two disparate cultural groups and allowing people to see themselves in these individuals, who are often from a completely different world than their viewers.

Phillips motions toward Spaceman, who’s sporting Ugg boots, a motorcycle helmet, and a creatively tied tie, and is holding a broom in a way that makes it look like a badass accessory. “I’ve drawn Spaceman several times,” he says. Tinesha, another subject of a life-sized drawing, wears dramatic eye shadow along with a puka shell necklace and is holding a to-go container. Phillips speaks highly of Tinesha and says she is incredibly sweet. 

Then he shows me Billy, one of his smaller drawings. Billy has a long beard and contemplative eyes. His shirt is tucked into his baggy cargo sweatpants, the cuffs of his light button-down shirt are undone, and his crossed arms frame his layered beaded necklaces. “This is Billy the Prophet,” he says. “I’m not sure if anyone other than me calls him that, but he’s definitely a prophet.”

After perusing his pieces, you might think Phillips is trying to impart some type of social justice-driven message or a call to action against poverty or homelessness. But Phillips says his goal is more about perception than social change. His hope is that if you see these pieces and grapple with this idea of how and why you treat certain people a certain way, then “hopefully the next time you walk by someone on the street you might think about this work and say, ‘Hey, I might not be able to fix shit, but I can at least smile; I can at least say hi.’”

After spending almost three years living at the corner of Sixth and Mission, cheaper rent lured Phillips out to East Oakland in April. He still comes back to his street corner, though. Not just for the next photo, but to continue his friendships with the people he’s photographed. He routinely runs into his subjects – now friends – and buys them lunch or art supplies.

“They know who I am on the street corner now. I’m that guy who draws people. And sometimes people even ask me to draw them,” he says.

Being the guy who draws people has allowed Phillips to become a part of the community. “I’m no longer this gentrifying white presence; I’m not the person who’s trying to change Sixth and Mission from what it’s been. I’m somebody who’s trying to understand what Sixth and Mission is,” Phillips says.

Don’t call it retro

LEFT OF THE DIAL Musician Bart Davenport, Oakland native, LA resident, has one caveat for discussing his move two years ago. He might’ve broken a few hearts, but he wants to make it clear that he did not head for the southlands for the same reasons many fed-up, underfed Bay Area musicians are making the same trek these days.

“My story doesn’t have anything to do with the changes that have been happening in the Bay Area the past few years. And it really wasn’t a career move. It has to do with changes I needed to make happen within myself,” says the singer-songwriter-guitarist. “Besides, I don’t even stay away long enough to miss it — I’m up there at least once a month.”

Lucky for us, one of those trips will take place next weekend, when he helps kick off the Mission Creek Oakland Music & Arts Festival with a daylong block party Sept. 6. Davenport headlines an eclectic lineup of acts that also includes the psych-rock-folky sounds of The Blank Tapes, B. Hamilton, Foxtails Brigade, and more at this opener to the fifth incarnation of Oakland’s 10-day, 14-venue music fest, which began as an offshoot to San Francisco’s in 2009. (If there are any lingering questions about the East Bay’s music scene holding its own at this point, this is the kind of lineup that answers ’em.)

Davenport has had a pretty hectic touring schedule since his most recent LP, Physical World, dropped on Burger Records in March of this year. There were the adventures in Madrid, the opening slots for Echo & the Bunnymen at LA’s Orpheum Theatre. Last week, playing guitar in Marc & the Casuals, he co-hosted a special one-off soul music-comedy-storytelling night at The Chapel. The day after he plays the MCO Festival, he’ll be driving “like a madman” back to LA to catch a Burt Bacharach show (as an audience member). He’s gotten used to life on the road.

As a kid, though, he mostly moved back and forth between Berkeley and Oakland, where he grew up near Lake Merritt — across the street from the humble, Disneyland-inspiring wonder that is Children’s Fairyland, with its old-school talk boxes that have been narrating fairytales at the turn of a key since 1950. (He’s still enchanted by it, but — as this reporter has also discovered during some routine research — adults wanting to visit the park are required to bring a kid along.)

Nostalgia might seem to be an easy catch-all theme for someone prone to memories of kids’ amusement parks, especially someone whose most recent record conjures the synthy New Wave anthems of ’80s with almost eerie authenticity one moment, then veers backward toward Buddy Holly the next — with each song seemingly narrated by a different character named Bart Davenport, and all of it so shiny that you can never quite tell when he’s being tongue-in-cheek. Davenport’s known for clear changes in genre and sound from record to record, but the shift from 2008’s Palaces (a Harry Nilsson-esque affair with Kelley Stoltz’s fingerprints all over it) to the distinctly palm tree- and pink pollution sunset-scented Physical World (which is full of soul and jazz chord progressions, and where Davenport seems to be channeling, by turn, Hall & Oates, The Cars, New Order, and Morrisey) is probably his biggest departure yet.

The singer takes issue with critics who would simply call him “retro,” however — though it’s not because he finds the term offensive.

“I actually think it’s insulting to purist retroists, people like Nick Waterhouse, maybe, who’ve gone to great lengths to recreate certain sounds really exactingly,” says Davenport, who credits longtime collaborator Sam Flax with sending him in a New Wavey direction after producing his power-poppy 2012 single Someone2Dance.

“And I don’t even think of myself as a very nostalgic person. I think of [my influences] more like shopping at the thrift store, and finding gems that you want to repurpose to say something new,” he adds. “It’s also that I guess many people try to avoid arrangements that sound like the way things were being done 20 or 30 years ago, and I tend to not really think about anything but what I like, what I think sounds good. It’s not about taking you to 1984 or taking you to right now, it’s about taking you into your own little world. The little world of that particular song, for just three minutes.”

Reticence to talk up LA in the Bay Area press aside, Davenport will allow that one of his major influences was his newly adopted city.

“It’s definitely an LA album,” he says, noting that about two-thirds of the record was written there, and it was recorded in Alhambra, near East LA. “I think the constant sunlight breeds a kind of optimism in people. Then there’s the scenery, the palm trees, the long crazy streets. The taco trucks. Where I live, the majority of people are Latino. It’s just a different mix.” Angeleno bassist Jessica Espeleto telling him she’d play in his band if he moved down south was one thing he had in mind, as well, before making the leap.

And yet: There’s no place like home? “The entire Bay Area has great venues,” says Davenport, as we discuss the new crop of venues that have sprung up in the East Bay over the last few years. “And yeah, especially with the musicians getting priced out of San Francisco, I think it’s great that there’s the whole East Bay for them to go to. Really, thank God for Oakland.”

Ranks of opposition to 16th and Mission development grow as Plaza 16 pushes forward

In the sea of nonprofit leaders, career organizers, and rabblerousers, one old man put the Mission’s struggle into context, last night [Thu/28]. It was a majority Latino district even as recently as the ’90s, he told the crowd gathered in St. John’s Episcopal Church last night. But now: “Here in the Mission, I can count the Latinos on my hands.”

The stakes are high as the Plaza 16 coalition raised its concerns about a proposed housing project that would tower over the BART plaza at 16th and Mission last night, with representatives from nonprofits and other organizations around the city gathering to seek more community support for the struggle. 

The 10-story residential behemoth proposed by Maximus Real Estate Partners is hotly contested. Organizers of Plaza 16  (so named for the plaza across from the development at 16th and Mission), say the development has only 42 proposed affordable housing units which would be built on site, and those aren’t even a sure thing. The rent for the rest of the building’s units range between $3,500 to $5,000 a month. Gabriel Medina, policy manager of the Mission Economic Development Agency, stated the obvious: That’s a price most current Mission residents can’t afford. 

“Does that sound like units for the Mission community?” Medina asked the crowd. “No!” they shouted in reply. 

Of course, the development isn’t meant for Mission residents, but for the incoming wave of upper middle class workers who can afford $42,000 a year in rent. But that sticker shock is only part of the problem.

Many supply-side housing development advocates argue San Francisco needs to build, build, build in order to offer enough housing supply to bring rental prices down (a theory many progressives disagree with). But last night, the focus was on exactly what type of construction the city is encouraging, and how that will hurt the Mission in the short term. 

I was born and raised here on 16th and Mission,” Elsa Ramos, 23, told the crowd, microphone in hand. “There’s no way for us to have another space. We’re a family of nine now, I just saw the birth of my first niece.”

Ramos is worried the Maximus development would drive up the price of her family’s unit, or lead to their eviction. When speaking with the Guardian, Ramos said her father has diabetes, and depends on city services for his healthcare. Her siblings all depend on city aid as well. Ramos’ fears were echoed by representatives of the nonprofits present, but scaled to the entire neighborhood. 

If everyone is evicted, we’re going to lose our client base,” Maria Zamudio, an organizer from Causa Justa/Just Cause, told the crowd. “We will not have clients to provide safety nets for. There will be no communities of color.”

Some of the nonprofit representatives present expressed concern with Plaza 16’s plan. “You can’t just show them you’re opposed,” one man said. “You have to show them your vision.”

Plaza 16 representatives said they want to see the Maximus project abandoned entirely. Some executives from Maximus were involved with predatory lending schemes, they allege. They also allege Maximus executives were partly responsible for the Parkmerced debacle, where many rent-controlled units were seemingly lost, the subject of a controversial court case. Maximus representatives didn’t return a Guardian call for comment. 

Though there was some dissent, ultimately the nonprofits gathered expressed unified support. The spectre of forcing longtime local residents into suburban ghettos lingered over the discussion.

Ferguson is [an example of] suburbanized poverty and segregation,” Medina told the Guardian. It’s one thing living in a low-income community in a city, he said, where nonprofits can lend aid like tutoring, shelters, free food or legal services. But like Ferguson, the suburban ghettos of the Bay Area often lack those safety nets, he said.

It seems the nonprofits present got the point, as over 15 new organizations joined the Plaza 16 coalition last night.

Midway through the meeting, Zamudio handed out cards to each of the nonprofit representatives present. A red card meant the organization would now support the fight against Maximus, an orange card would signify a need to stay neutral, a green card meant Maximus support, and a yellow card would signal an undecided vote.

When asked who was in support of the coalition, a sea of hands with red cards raised up high.

They say it’s a gold rush. This isn’t a gold rush,” Carlos Gutierrez from HOMEY told the crowd. “This is where people live, these are people’s homes.”

Predicting earthquakes, from 14-year-old prophets to train-stopping ShakeAlerts to lessons from disaster flicks

Earlier today, I called my mother, a natural disaster film junkie, and asked her, “Do you know of any movies where someone predicts natural disasters, but no one believes the guy, and so everything goes a little haywire?”

“10.5, Day After Tomorrow, 2012, Volcano, Deep Impact, and Knowing,” she replied without any hesitation. “But in Knowing the protagonist gets help from aliens to predict disasters, so I don’t know if that’s bordering on fiction.”

Despite the hundreds of natural disaster blockbusters warning the public to listen when someone predicts catastrophe, earthquake prediction technology can’t defeat the rules of physics and the unpredictable nature of shaking earth. When a 14-year-old from Florida claims he predicted the recent Napa earthquake, for instance, doubts are raised, heads were tilted, and facts must be checked at once. 

“I started jumping up and down when I heard about the earthquake,” high school student Sugganth Kannan told us.

Kannan was sad about the destruction, sure, but he also thought the earthquake’s timing, location, and magnitude validated his prediction that an earthquake with a magnitude of at least 5.0 would occur 50 miles from the South Napa location within 180 days from last December when he made the prediction. So, he was close, but off by a few months. 

To make his prediction, Kannan used the Spatial Connect Theory, which states that all earthquakes within a fault zone are related. Then, looking at past earthquakes, he made functions based on the angle of change, geographical difference, and the time between earthquakes to eventually come up with a pattern. His work has been published in the Journal of Geology & Geosciences

Of course, earthquakes in California are both as no-kidding-predictable as they are scientifically unpredictable. According to the US Geological Survey, which cites studies examining the past 14,000 years, catastrophic earthquakes strike along the southern San Andreas fault about once every 150 years. And if you don’t believe the US Geological Survey, there’s always Lt. Gov. Gavin Newsom, who has stated, “There’s a real likelihood of a major, major earthquake in the next 10, 15, 20 years.” We’re seismically active, and we know it. 

While 14-year-old Kannan and the lieutenant governor might want futures as earthquake prophets, Richard Allen, director of the Berkeley Seismological Laboratory, is just happy he can predict earthquakes within 10 seconds of their first furious rumble. He helped pioneer an early warning system called ShakeAlerts that’s currently got 150 subscribers and does just that. 

Now there’s an idea for a natural disaster movie: Nicholas Cage predicts an earthquake a whopping 10 seconds before the disaster happens, causing BART trains to automatically come to dramatic, adrenaline-rushing halt, saving thousands of lives! It might not be fodder for disaster movies, but it is good news for actual and real world of real and actual earthquakes. 

BART is one of Shake Alert’s users. When the Napa earthquake went off, an alarm went off at BART’s offices announcing an approaching earthquake. Spokesperson John McPartland explained at a press conference on Monday that the trains moving at 33 MPH or less would have stopped had they experienced a a 3.1 earthquake or higher. But in the Bay Area, the magnitude was much smaller, and the trains raced on, unknowing.

“If there’s an earthquake, and you’re on BART, the best thing you can ask for is for the train to stop,” said Allen. You can check out a video for CISN ShakeAlert here. In the video, you can hear buzzing, and then a somewhat intense robotic voice telling you, “Earthquake! Earthquake! Light shaking expected in 10 seconds. Earthquake!”

“The farther away from the earthquake, the sooner you’ll get the alert,” Allen told the Guardian. “In the best case scenario — as in, the worst case scenario earthquake — you’ll get up to a minute warning. For this one, BART got 10 seconds. There’s no way to improve that. It’s physics.”

He hopes to get more funding to bring ShakeAlert to more people, and to one day develop a mobile app so anyone can be alerted seconds before an earthquake occurs. Ten seconds might not sound like a lot of time, but for those knitting with dangerous needles, or cooking with sharp knives, or just generally doing things not conducive to huge earthquakes with large, pointy things, 10 seconds could mean a whole lot. Although California Gov. Jerry Brown signed a law to turn Shake Alert into a statewide program last fall, the project has only received $10 million of the $80 million it needs for new sensors and infrastructure. 

Then there’s virtual reality. Michael Oskin, a professor of earth and planetary sciences who studies earthquakes and seismicity at UC Davis, has taken his students to the site of the Napa earthquake to take photographs of the destruction and use the photographs to build 3D models to help them understand the wrath of the quake and what could come next.  At UC Davis’ W. M. Keck Center for Active Visualization in Earth Sciences (KeckCAVES), researchers get to experience earthquakes virtually and take heed. 

Much of Oskin’s work with virtual reality assimilation revolves around looking at earthquakes before and after they’ve occurred, examining the fault lines throughout these phases, and studying how the faults have moved afterwards. 

“If you want to understand the record of faulting, you look at earthquakes that have just happened to see how complicated they are and how they’ve changed. Then you get a better sense of how to interpret them,” Oskin said. From there, he can also create a virtual world to provide a visual of what could happen to houses built along fault lines.

“Hopefully in 20 years, the tools will be available for everyone to use – on laptops and 3D TV screens so you can visualize an earthquake on a screen in 3D,” Oskin said. “It’s not high end software. It’s just creative programming.”

If earthquake forecasting apps for all is the dream, we’re certainly getting closer. John Rundle, a UC Davis physics professor, co-launched OpenHazards.com, which produces earthquake forecasts and a mobile app. 

“What we do is we count smaller earthquakes to forecast bigger earthquakes,” Rundle explained. “Once a magnitude 6 earthquake occurs, like the one in Napa, we start counting the number of small earthquakes that occur in the region after that. Once we get 1000 earthquakes with a magnitude of 5, it’s time for another 6 to occur. We convert that statement into a probability around the world, every night, and display it on the website.” 

Rundle said his system has a 80-85 percent accuracy rate.  “If you were to make a whole bunch of random forecasts today, and you were to do that tomorrow and the next day and then compare the forecasts we use, Open Hazard would be better 80-85 percent of the time,” he explained. “That’s roughly equivalent to a weather forecast three or four days into the future. That’s where our accuracy is.” 

Back in 2012, an Italian judge convicted seven scientific experts of manslaughter and sentenced them to six years in prison for failing to give warning before the April 2009 earthquake that killed over 300 people. But that’s why earthquake forecasting is called forecasting, and not predicting. Fortune tellers may not be trusted, but you can’t kill the weatherman, especially over quakes.

BART launches internal affairs investigation into tackling arrest of black man

The Bay Area Rapid Transit Police Department has launched an internal affairs investigation after an officer tackled and subsequently arrested a suspect, the Bay Guardian has learned. The nature of the complaint leading into the investigation is not yet known, but statements from the suspect’s attorney indicate it may be racially motivated. 

The man, his attorney alleged previously, was potentially racially profiled. Last week, the San Francisco Examiner reported a man was tackled and arrested by BART police in Powell Station. This man did not match the description of the suspect police sought, his attorney said, except for one characteristic: he was black.

When the Guardian asked BART Deputy Police Chief Jeffrey Jennings if we could look at the police report, we were denied due to an internal affairs investigation into the case. The man in question asked the Examiner for anonymity due to fear of retaliation. 

“Understandably, he’s scared to take BART now,” Rachel Lederman, his attorney and the president of the Bay Area chapter of the National Lawyer’s Guild, told the Examiner.

Police were searching for a man dressed in black who accosted a woman in Powell Station earlier. But the man they tackled wore blue jeans and a grey jacket. After he was tackled to the ground, the man was charged only with resisting arrest, indicating officers concluded he was not the suspect they were looking for.

“The gentleman was charged with [Penal Code] 148, resisting/obstructing an officer while in the performance of their duty,” Jennings told the Guardian. “My detective unit filed the case with the San Francisco District Attorney’s Office and they chose not to prosecute him for this charge.”

But their reasons for suspecting the man they eventually tackled weren’t based on any part of his description, except his race, based on the information available.

About 6:55 p.m. Sunday, BART police received a report that a female patron had been grabbed and hit by a male panhandler when she refused to give him money, BART spokeswoman Alicia Trost said. The victim reportedly described the suspect as a black male who was wearing all-black clothing.

However, when officers arrived on the platform, they approached another black male who was wearing a light-gray jacket and jeans. BART police said the man tried to walk away when they approached him.

Officers subsequently hit the man, knocking him backward, then tackled him and took him into custody.

The victim, according to Trost, could not positively identify the man BART police detained, but he was arrested anyway.

We asked Jennings directly if the man was actually the person they were looking for, to which he replied, “There appeared to be enough information to talk to the person and that person turned the conversation into a lawful detention, and eventually he was arrested based on his actions.”

A brief Instagram video from a bystander of the arrest show the police tackling the man, who is wearing fitted blue jeans and a light grey jacket. “What the fuck is your problem man?” he shouts as he’s grappled and brought to the ground by an officer and a bystander. “I didn’t do shit! I didn’t do anything!” he continued, as another officer joins the fray to restrain him.

When the Guardian asked Lederman if the man would pursue a case against BART police, she did not get a definitive answer either way.

“I can’t comment on that now,” she wrote in an email, but “will have a comment on it in a couple months.”

BART internal affairs has 67 open investigations, which is 23 cases more than the same time last year, according to BART’s Office of the Independent Police Auditor.

Mount Kimbie

Around the time dubstep started making its rounds with American artists and audiences in the late ’00s, a host of Londoners were developing the style into something more experimental. Among the earliest practitioners of this “post-dubstep” style was Mount Kimbie, which dropped its debut, Crooks & Lovers, in 2010 and unwittingly became one of the genre’s most influential practitioners. Though the duo may not skew as pop as its contemporary James Blake, Mount Kimbie has maintained a loyal following among electronic music fans, and it’s esteemed enough to have released its second album, Cold Spring Fault Less Youth, on the prestigious Warp label. Featuring guest vocals from London pop prodigy King Krule, Cold Spring only bolstered the duo’s reputation after its stripped-down sound had already made a mark on the mainstream. (Daniel Bromfield)

El Terrible

Not too many people have seen El Terrible yet. The band announced its arrival quietly at the start of the year with the release of its eponymous debut EP, a murky four-track affair that evokes the guttural vocals of Joy Division and the intricate guitar sounds of My Bloody Valentine. While it may be a new band, the members of El Terrible are all journeymen of the SF music scene. Main writer and singer Terry Ashkinos was formerly the frontman of SXSW veteran Fake Your Own Death, while his live band, made up of locals Scott Eberhardt and Adrian McCullough, has also been on the scene for many years. Get ready to celebrate, as the group will be performing and dropping its new single at this show. Also playing are Rich Girls, the solo project from The Black’s singer Luisa Black, and Katelyn Sullivan’s acoustic Kitten Grenade, which has been performing all over the city and making quite a splash over the last few months. Midnites for Maniacs: Popeye and The Wiz

This might appear to be an unlikely double bill of musicals, until you take a look at its stars: Robert Altman’s mile-a-minute 1980 musical Popeye has the recently departed, greatly loved Robin Williams doing his manic thing in the title role, with Shelly Duvall at his side as Olive Oyl, in a performance that makes it hard to imagine any other (live-action) human taking the part on. The Wiz (1978) features another seemingly divinely-inspired talent gone before his time — a 20-year-old Michael Jackson as the Scarecrow to Diana Ross’ Harlem-dwelling Dorothy. Bonus: Richard Pryor as the Wiz. This could count as tearjerker programming, if each of these films wasn’t so likely to make you grin instead. (Emma Silvers)

Mission of Burma

It’s been 33 years since Boston’s Mission of Burma unleashed its initial volley of sound, an EP and an album, Vs., followed by more than 20 years of silence. While the band unleashed 70 minutes of recorded material before an unfortunate breakup spurred by singer and guitarist Roger Miller’s worsening tinnitus, the group grew in stature for the next two decades. After an unexpected reunion in 2004, Mission of Burma has released four additional critically-acclaimed albums. The most recent, 2012’s Unsound, is full of impossibly fast tempos, odd tape-loops, and complex rhythms — generally the band’s modus operandi, but even more amped up than ever before. Truly ageless and anything but a nostalgia act, the band hasn’t visited the West Coast in upwards of four years. This set should include both stuff from the ’80s as well as newer albums, along with (if we’re lucky) a couple of delightfully dissonant Beatles covers the band’s been known to play on special occasions. Dev

If you listened to the radio at any point during 2010, you’ve probably heard Dev’s uncanny-valley croon on Far East Movement’s reference-heavy single “Like A G6.” But she’s since surpassed the shadow of that song, releasing the equally prom-wrecking single “In The Dark.” With her processed vocals and lewd lyrics, Dev is often compared to Ke$ha and her Parisian foil Uffie. However, Dev differentiates herself from those artists with a subdued, detached vocal style and a love of space-age, almost loungey production. Though she may or may not score another pop hit, she’s certainly not going anywhere — she released an excellent and surprisingly experimental EP with producer Nanosaur last month, and she’s currently prepping another EP, Bittersweet July, scheduled to drop Sept. 23. Put down your iPhone, tablet, or other glowing device and stop thinking about zines in the past tense. DIY culture is thriving, and the San Francisco Zine Fest — which returns to Golden Gate Park this year — spotlights indie artists and writers, small presses, and the readers who love them. This year, there’ll be panels on “Race, Gender, and the Future of Zines” and “Creating Feminist Spaces in DIY Culture;” an “Intro to Silkscreen” workshop; and a rather impressive slate of exhibitors and special guests, including Ryan Sands (Youth in Decline), Tomas Moniz (RAD DAD), and illustrator-cartoonist Hellen Jo. SF Shakespeare Festival’s The Taming of the Shrew

Shakespeare’s The Taming of the Shrew has always been one of his most controversial plays, both for its rampant misogyny and its unique framing device — the protagonist, Petruchio, performs the entire play as a diversion for a drunk. The production he puts on is a retelling of the courtship of his wife Katherina, the “shrew” in question, who he eventually manipulates into being a devoted wife. Despite its turbulent reputation, the play is frenetic and funny, replete with sexy (and yes, particularly sexist) banter and a series of subplots involving winning women through feats of athletic and mental strength. The San Francisco Shakespeare Festival presents the play in its original setting, Renaissance-era Padua, and promises to play up the physical comedy, costumes, and clowns that punctuate faithful versions of the text. Cross your fingers that the weather is sunny, bring a picnic blanket, and enjoy the Presidio and the brilliance of the Bard. (Kurlander)

Pookie & the Poodlez

I saw Pookie open this year’s Burger Boogaloo with a toothbrush still in his mouth; the story was that he’d overslept for his slot but luckily lived close enough to Oakland’s Mosswood Park to drive over in 15 minutes. Though I have no idea whether or not there’s any truth to this story, it’s a neat anecdotal summary of Pookie & the Poodlez’ aesthetic — sloppy yet endearing in an almost teen-idol way. Pookie’s pinched, nasal voice isn’t that far removed from that of Seth “Hunx” Bogart, with whom he has a degree of separation through performing with Bogart’s old flame Nobunny. But Pookie is weirder, more stoned, more affable, and less concerned with performance or with subverting pop tropes than he is with banging out minute-and-a-half pop-punk songs with little pretense or pretention. Oakland Pride Parade and Festival

San Francisco may get all the glory, but Oakland? Oakland’s where Sheila E.’s from, and that, friends, is why Oakland’s annual pride celebration gets the drum queen as a headliner and celebrity grand marshal. The festival, which will take over downtown Oakland until 7pm, features three stages with a stacked bill full of live music, a children’s area, a senior area, and a “wedding pavilion” where couples will be able to tie the knot — there’s a story for the grandkids. And of course, food, booze, and all your favorite LGBT organizations will be out in style. Worth the BART trip? And how. (Emma Silvers)

Gina Arnold

Bloomsbury’s 33 1/3 series of compact volumes examining popular albums offers a range of both musical styles (Dusty Springfield, ABBA, Jethro Tull, DJ Shadow, Sonic Youth, Van Dyke Parks, Guns N’ Roses, Celine Dion) and authors (John Darnielle, holding forth on Black Sabbath). The 96th entry comes from veteran rock journalist and recent Stanford Ph.D Gina Arnold, whose take on Liz Phair’s 1993 grunge-grrrl thesis Exile in Guyville offers what the New York Times calls “the most curious” entry in the 33 1/3 canon, taking a “free-form” approach rather than simply combing through each of Phair’s lo-fi anthems. Seems kinda perfect, considering Phair’s own unconventional music-biz approach — plus, any excuse to revisit “Fuck and Run” is always welcome. (Eddy)

Live shots: Pro-Palestine activists block ship at the Port of Oakland

Pro-Palestine activists marched on Saturday to block an Israeli ship scheduled to dock at the Port of Oakland, protesting Gaza violence.

Well over 1,000 protesters marched from the West Oakland BART station to the port to block the Zim Piraeus, operated by Zim Integrated Services, Ltd., from docking and unloading its goods. As of last night the ILWU respected the Block the Boat picket line. A police line met the protesters when they arrived.

Film festival organizers call for safer San Francisco streets

Editor’s Note: Aug. 19 marks the Bay Area Global Health Film Festival, hosted by the Institute for Global Orthopaedics and Traumatology. The theme of this year’s festival is “Road Traffic Safety Locally … and Globally,” and is geared toward raising awareness about the need for road traffic safety improvements. In this opinion piece, representatives from the University of California at San Francisco Orthopaedic Trauma Institute, at San Francisco General Hospital, describe how all-too-common accidents can permanently injure pedestrians and bicyclists. And they voice support for Proposition A, the San Francisco Transportation and Road Improvement Bond.

San Francisco is a transit-first city. Everyone shares the need to get safely from point A to point B, preferably quickly. And the various options for doing so span the full spectrum from driving, biking, and walking, to public transit like MUNI and Bart, rideshare programs, taxis, and companies like Uber and Lyft.

As we go about our daily lives, transportation is one of the most important public infrastructure systems that San Francisco relies upon. It encompasses many controversial issues and is linked to other social equity campaigns including housing advocacy and urban gentrification.

Yet the issue of pedestrian and bike safety in San Francisco has made disheartening headlines as of late. 2013 was an especially deadly year, with 21 pedestrian and four bicyclist fatalities. San Francisco General Hospital alone cared for over 1,000 road traffic injuries, with an estimated $60 million annual cost. Organizations like the SF Bicycle Coalition and WalkSF have made biking and walking leading issues in debates over transportation policy and traffic safety. Mayor Ed Lee and our city government have responded by introducing a $500 million transportation bond measure for the Nov. 4th ballot. If it passes, a portion of the funding will be allocated for improving pedestrian and cyclist safety.

Less often discussed, however, is what happens to the pedestrians and bicyclists who are hit while going about their daily routines and permanently affected by all-too-common accidents. At the UCSF SFGH Orthopaedic Trauma Institute (OTI), these patients fill our wards, the operating room schedule and our hearts as we help to heal them from these injuries. We struggle with the balance between doing what we can and what should be done to curb the growing volume of patients we see annually due to preventable accidents.

What is alarming is the socio-economic impact these accidents have, not only on the person affected, but on the hospital and our city as a whole. Even in cases where the driver is at fault, it is rare for them to even be cited for a traffic violation in most cases. More importantly, personal injury insurance and health coverage barely cover the emergency services needed for these accidents, and most services offered at the hospital are subsidized by taxpayer dollars, which means we are paying for this on all sides. This is unacceptable.

There is currently a wave of momentum to address these complex issues and attempt to tease through how we as a city can rebuild, redefine and reinforce the safety in our city. This movement is supported by a global platform addressing road traffic safety as a public health campaign, through the World Health Organization’s Decade of Road Traffic Safety. This campaign tackles the myriad polices and resource investments needed to address the enormous impact road traffic accidents have on the world. 

Injuries, mainly those resulting from road traffic accidents, account for greater disability and death than HIV, TB and Malaria combined.  An average 5.8 million die annually, and for every death caused by these accidents, eight to 10 more are permanently injured.

To bring collective awareness around this issue and to change the landscape, the community needs to stand together not only in San Francisco but also around the world, to demand safer streets. The city is doing its part to outline a roadmap to curbing these alarming statistics, and a greater global campaign is underway to promote awareness and inspire activism.

We must stand up for the injured and for ourselves as local citizens to demand safer streets and protection from when accidents occur.  We may not be able to prevent every accident, but we can improve the choreography of their outcome if we work together.
