We don’t typically use the expression “start-up” when talking about restaurants — the phrase belongs to Techtopia and implies, at least to me, oceans of venture capital and huge salaries for people who run companies that don’t make money. But if we did, Straw would be an ideal one. It’s the sort of place one saw quite a few of in the early to mid 1990s, in that interval between the disasters of stock-market-crash-earthquake-war-fire and the start of the first tech boom. In that moment, people seemed to feel a renewed sense of optimism but didn’t have pots of money. The result was a sequence of new restaurants offering superior food, high value, and modest (sometimes DIY) décor. If you couldn’t afford to have Cass Calder Smith design your dining room, you could still somehow let it be known, through the medium of unprepossessingness, that you were reserving your best efforts for the food and service.

Straw, in this important sense, feels like a throwback from 1995. The restaurant (which opened in January) is small and slightly scruffy and is in an old building — a small oddity along Octavia Boulevard, which is newness itself and has been the occasion for all sorts of fresh construction in the past few years. The white walls, slightly scuffed, are hung with carnival posters, and some of the window seating seems to have been salvaged from a ride at a state fair somewhere. We haven’t had a place like this in more than a decade, I don’t think, not since the days when 3 Ring tried to make its circus theme fly in the old Val 21 space (now Dosa) on Valencia.

What kind of food would you expect to find at a carnival? Straw does provide some witty answers to this question, but the menu ranges gracefully beyond the obvious, which is to say the fried. Still, the fried stuff is good — a basket of little corn dogs ($7.75) made of Niman Ranch beef and looking like batter-fried musket balls. These were wonderfully crisp and juicy, and the trio of dipping sauces — nacho cheese, spicy ketchup, and ranch dressing — each had a strong enough personality to make them distinct, one from the others. The prawn ceviche ($7.75), boldly seasoned with habanero, lime, cilantro, and red pepper was presented in a fried tortilla cup, the kind tortilla salads come in, along with some tortilla chips on the side. These turned out to be good for dispensing with the last of the corndog sauces.

But not everything is fried, and the kitchen helps itself to a wide variety of influences. Grilled cobs of corn ($4) sprinkled with feta cheese, cayenne, and chili powder and presented with fresh lime and what the menu calls, with charming redundancy, “garlic aioli,” seemed to have Mexican roots, while the mac ‘n’ cheese ($5), fortified with bacon and slices of apple (an excellent idea) was a nice little crock of Americana.

The menu is also vegetarian-friendly — and not just in the small dishes, though quite a few of those are meatless, among them the tomato soup, pretzel bites, and several of the salads. An entrée called samba on subuco ($12), festively joined chunks of butternut squash and eggplant in a slightly sweet (but not cloying) coconut-milk curry broth reminiscent of many a hormak talay in Thai restaurants. This dish succeeded for me, despite the eggplant, which managed to be both rubbery and mushy.

Places are found for flesh too, often cleverly. We were particularly impressed by the satchemo ($15), a bed of creamy white grits carefully inlaid with sautéed prawns, leaves of linguiça, and green filet beans. Apart from being flavorful and well-balanced, the dish was beautiful to look at: like a tile taken from the palace of an Ottoman pasha.

I was a little less impressed with the picadilly ($14.75), if only because I wonder if a fish as marvelous as ahi tuna needs to be turned into fish sticks. Ahi, like beef, can stand on its own and is generally best when standing on its own. It doesn’t take all that kindly to elaborate treatments and back-room, hardball techniques like breading and frying. Doing that to a nice piece of ahi is a little like getting out your best lead crystal to serve some Diet Coke. The accompanying mayonnaise was astounding, however.

No carnival would be complete without a root beer float, and Straw offers a nice one ($5.50), made with root beer gelato and served with a straw (!)— not exactly radical ideas but sound ones. The more radical idea was laying little sticks of candied bacon atop an almost impossibly creamy peanut butter pie ($6) in a chocolate crust. Peanut butter and chocolate are one of sweetdom’s divine combinations (also totally New World), and I’d never heard the pair were looking for a third, certainly not pork. The truth is that the pie would have been fine without it. But the meat brought a bit of salty-sweet chewiness for contrast, and the result was better than fair.

I never regret the morning after — but sometimes the night before can stick to my face like Ragu to Tupperware, child. It’s not always pretty! OK it is, but sometimes it’s slightly less so. So when I heard that the nifty new vintage-groomin’ F.S.C. Barber in the Mission was offering something called the Hangover Treatment facial, I leaped to try it.

I mean, I’m usually about as resistant to professional beauty treatments as I am to shaved chests on porn stars or pulmonary tuberculosis. I hope. But the rituals of modern manhood are startling — one day you’re lighting up a Cuban fedora with a baseball bat you shot at par nine while building your own Playboy smoking jacket. The next you’re lying back in a beautiful vintage barber chair (complementing F.S.C.’s 120-year-old restored mahogany barber stations from the Chicago World’s Fair) while an amiable, impeccably fashionable tattooed guy named Brett massages your face. 

It was bliss, a multi-part treatment of lavender and eucalyptus hot towels with a bubbling Malin + Goetz mask that really did make me feel like “a million buckaroos.” (It costs $25.) Who wants more cocktails?

F.S.C., which is all the rage in its Manhattan homebase where there are two branches already, may put out a men’s club vibe, but it’s not really that uptight or theme-y. It has a tasty little clothing shop attached called the Freemans Sporting Club, and manager Jonah Buffa, who opened the SF outpost (his brother Sam is the F.S.C. founder), is as sweet and laid back as they come, a true Missionite raising his kid in the neighborhood.

T.I.M.F. T.M.I. The lineup for this year’s ever-zesty Treasure Island Music Festival (October 15 and 16, www.treasureislandfestival.com) was announced last week, and as usual it’s unofficially segregated into a “dance” day (Saturday) and a “rock” day (Sunday). On my personal “dance day” must-see list? Flying Lotus, Buraka Som Sistema, Shabazz Palaces, Battles, and — hurray for random — Death From Above 1979. There’s no over-the-top pop-dance draw this year (although grime-rapper Dizzee Rascal’s latest “Bonkers” incarnation should please any, goddess help us, Steve Aoki or LMFAO fans).

Also as usual, there’s the merest appearance of Bay Area talent — lovely local chamber-pop outfit Geographer pops in to start things off on Saturday. It seems a shame, and a failure of nerve, since we have so much worthy homegrown dance talent. Could they set up a dance tent with continuously spinning local DJs, as an alternative to the stage acts? That would be dandy.

Monthly based-goth, witch house and deathrock party 120 Minutes goes darker than ever with a live set by Nike7UP, who melts the chirpy underbelly of chart-pop into a suicidal wish-blorp. GuMMyBeAR, Nako, WhITCH, Teams, and more haunt your earholes.

STEFFI AND MIKE HUCKABY

Huckaby was long the secret weapon of Detroit’s techno scene, a DJ’s DJ who was key in introducing a lot of the Big Names to new sounds. He’s finally getting the breakout recognition he deserves — in May, I saw him open the reconfigured garden of Berlin’s huge Berghain club, bringing a welcome dose of deep to that spring affair. (Listen to his awesome new mix for XLR8R here.) Steffi, whose hit “Yours” might as well be from Detroit in 1988, comes to us from Amsterdam via Berlin, and she’s aces.

Ready for funkytime? The ESL label brings out soulfully gifted DJ Nickodemus of sunny house party Turntables on the Hudson for a throwdown with the Afrolicious boys (featuring live drums!), and Rob Garza of Thievery Corporation. Plus: two of my fave clubs, Surya Dub and Dub Mission, duke it out on the upstairs dance floor of Public Works, with DJ Sep and Kush Arora taking turns at the tables. Kush tells me he’s breaking out some rare kuduro and deep afro-house, so get ready to drop.

SPEEDY J

The Dutch master of hard techno was famous in the 1990s for wigging crowds out, true to his name. He still brings the wiggy floor-stomp, but after moving to Berlin and embracing a few minimal and experimental tricks, he’s gone deeper and broader, killing it with painterly tech effects. He’ll be blowing the monthly Kontrol party away with opener M. Gervais.

FOREVER’S GONNA START TONIGHT

Last month, the nightlife community lost one of its true legends, Vicki Marlane of the Hot Boxxx Girls revue at Aunt Charlie’s Lounge. At 76, she lived an incredibly rambunctious life and was thought to be the oldest continuously appearing transgender stage performer in the country. She gave every number her all — and considering her propensity for epic numbers like “Total Eclipse of the Heart,” that was a lot of all!

Come celebrate her gorgeousness on Sat/6 at the Castro Theatre, when the awesome and informative 2010 documentary about her, Forever’s Gonna Start Tonight, screens at midnight with bonus performance footage that will bowl you over. It’s a benefit for the AIDS Emergency Fund — appropriate for Vicki’s generous spirit.

Mayor’s race a tight pack, but Gascón lags in DA’s contest

Despite the hype and spin from various mayoral campaigns and newspapers, the big story in yesterday’s release of semi-annual campaign finance reports is that there isn’t much of a story: It’s pretty much what everyone has been expecting, a tight field of qualified mayoral candidates with comparable financial resources.

It was also no surprise that Progress for All, the deceptive committee behind the effort to draft Mayor Ed Lee into breaking his word and running to keep his job, was funded mostly by a narrow group of business interests connected to longtime power brokers Rose Pak and Willie Brown, mostly with $5,000 contributions, or 10 times the contribution limit for legitimate mayoral campaigns.

The real story in yesterday’s numbers was in the district attorney’s race where the conventional wisdom that incumbent George Gascón is the clear frontrunner (“wisdom” that we’ve always questioned given his lack of local roots) was cast into doubt by his lackluster fundraising, big spending for small results, and the fact that each of his two major challengers have twice as much money in the bank.

Alameda County prosecutor Sharmin Bock led the fundraising race this year with $240,337, about $6,000 more than Gascón. And after spending $156,916 in just six months, Gascón has just $77,570 in the bank. David Onek, who has been getting progressive support and retail campaigning up a storm, raised $126,386 this year, but his early start and frugal spending leaves him with $153,474 in the bank.

In the mayor’s race, while both the Chronicle and Examiner led with David Chiu’s impressive fundraising this year, leading the pack with almost $400,000, all that really did was put him into financial contention with the top-tier candidates who have been raising money since last year: Leland Yee, Dennis Herrera, Bevan Dufty, Joanna Rees, and Michela Alioto-Pier.

As of last month, their campaigns’ cash-on-hand was Herrera at $586,294, Dufty at $493,372, Yee at $444,820, Ress at $441,168, Alioto-Pier at $406,574, and Chiu at $396,754. On the next tier down, Phil Ting appears dead in the water, raising just $67,526 and having more debt than money in the bank, although his campaign consultant Eric Jaye said public funds are just starting to come in and the campaign is on track to meet its $300,000 fundraising goal.

Two other major candidates were also well behind the pack, but both are running with an outsiders’ appeal that should keep them in the running throughout the race. Tony Hall, a conservative with a strong independent appeal, raised $102,612, has $173,368, and will likely continue nipping at the heels of the mainstream pack.

And then there’s progressive favorite John Avalos, who has been running a visible, enthusiastic campaign with lots of volunteer support, although he raised just $86,882 this period and has about $100,000 in the bank (contrary the erroneous report in today’s Chronicle that he only had $500, apparently because the reporter looked at his supervisorial campaign report instead of his mayoral – whoops).

But Avalos supporter Chris Daly said the campaign has recently raised another $32,000 and is due to soon receive about $120,000 in matching funds, bringing them up to around $250,000. “That’s what [then-mayoral candidate Tom] Ammiano had in his entirety in ’99,” Daly said, noting that progressive mayoral favorites always get outspent and usually by margins greater than what Avalos now faces. “Our people don’t have as much money or city contracts.”

By contrast, Chiu has been raking in the dough this year, with lots of $500 contributions mostly from lawyers, bankers, developers, people with Chinese surnames, and employees of Google and other tech firms, with almost half of the contributions from out of town.

“We raised almost a hundred grand more than the closest competitor,” said Chiu campaign manager Nicole Derse. “We’re in a super strong position.”

In addition to the big money sources that usually gravitate to strong moderate candidates, Chiu also had some notable financial support from some progressive constituencies, including bicyclist activists (such as Gary Fisher, Dan Nguyen-Tan, Jason Henderson, architect David Baker, and MTA member Cheryl Brinkman), progressive activists Susan King and Amy Laitenen (Matt Gonzalez’s former board aide), and medical marijuana advocate Kevin Reed from Green Cross.

Jim Stearns, who is running the Yee and Bock campaigns, said the funding picture is about what he and others predicted would be the case given public financing (and its $1.475 million spending cap) and the large field of qualified candidates. “That’s the interesting thing about this race, it’s like the World Series of Poker with everyone getting the same stake,” he said. “This is unlike every other mayor’s race where there have been huge disparities in funding.”

Many political analysts privately fear that this dynamic, with nobody really pulling away from the pack of candidates, could encourage Lee to get into the race. But Stearns notes that Lee, despite the power of incumbency, will have a hard time catching up in fundraising and a huge target on his back because of breaking his word, the sleazy “Run Ed Run” campaign tactics, and just the fact that he would become the instant frontrunner.

“In the ranked choice voting scenario, if there’s someone who looks like he’s going to come in first, you don’t lose anything by attacking him because his second place votes aren’t going anywhere,” said Stearns, who said the current mayor’s race appears to be a game of inches. “It’s an infantry game rather than an air game, where the gains are slow and people are proceeding carefully.”

Our theme for 2011 is “Beautiful Rebels” — and inside this year’s Best of the Bay, we’ve highlighted eight of our favorite “beautiful rebels” who we think are helping change the Bay Area for the better.  Throughout its history, the Bay Area has attracted wave upon wave of people looking to create something unique. From Barbary Coast explorers to Belle Epoque, Jazz Age, and Beatnik free spirits, from hippies and queer and civil rights pioneers to tattooed 1990s swing kids and Burning Man visionaries, to today’s global tech innovators and their DIY, local, organic, small-batch counterparts. 

We seem to be living in a time when a certain conservatism and conformity reigns, when speaking out gets you pilloried in the comments section and big-box consumerism squeezes out charming idiosyncrasies. That’s why we wanted to take this Best of the Bay opportunity to celebrate the Bay Area’s proud perseverance in remaining the weirdest, oddest, most interesting and rewarding place in the world, somewhere where “freak” is a compliment and “out there” equals “gorgeous.”

In 1974, Esquire magazine asked us for ideas for its Best of the USA issue, which led to us publish the original Best of the Bay. Made by the people of the Bay Area for the people of the Bay Area, it’s our annual opportunity to celebrate the people and places that make this city great. We were the first weekly paper to publish a regular “best of” issue. Thirty-seven years on — and 45 years after we opened our doors — we’re still going strong.

Editing this year’s installment was a hoot. I shower grateful smooches on all my collaborators, especially my right-hand amiga Caitlin Donohue, creative wiz Mirissa Neff, amazing illustrator Renee Castro, photographer Ben Hopfer, the Guardian staff, and the ever-supportive Hunky Beau, my own personal Best of the Bay.

But most of all I thank you, dear reader, for your generous participation, for making the Bay Area such an astounding place to live, and for turning us on to some great new things this year.

ABOUT THE ILLUSTRATOR

Like the Guardian, Renee “Lady Reni” Castro is native to the Bay Area — really. Born in Oakland, Castro’s heritage stems from the Ohlone Native American tribe. (You can’t get more local than that.) Her background serves as inspiration for much of her art, especially her subjects’ clothing and their deeply-rooted connections to the natural world. Her other influences for her illustrations in this year’s “Beautiful Rebels”-themed Best of the Bay include Mexican and Spanish folklore, broken-hearted femmes fatales, disheveled muses, and erotic heroines. A visit to the cavernous Potrero Hill digs of Big Daddy’s Antiques ushers you into a wondrous, uncannily postmodern version of the past. There’s definitely a little vintage-meets-steampunk aesthetic going on — Big Daddy grand poobah Shane Brown and his magic elves have collected enough old-school film lights, globes, wooden angel wings, horse-drawn buggies, large animal heads, giant pillars, and studio cameras with bellows to kit out the dreams of antique queens and cyber-fanboys alike. (Tech guys, please get your decor here.) And the large collection of Depression-era Americana like shoe shop signs and flag bunting adds to the pleasantly discombobulating Twilight Zone feel. BEST VINYL FLIPPERS

Tweekin Records in the Lower Haight was one of the centers of Bay Area dance music culture for the better part of two decades. But besides the basic insanity of operating a specialty record store in these e-times, the Tweekin brand had gotten a bit ragged over the years. So it was a charge for vinyl lovers when Manny Alferez and crew stepped up for a reinvigoration, unveiling Black Pancake Records. Pretty much the same concept reigns: great funk, soul, house, techno, jazz, and even (gasp!) rock records, plus a friendly staff with some primo recommendations. Perhaps best of all, there are a couple of those rarest of beasts — listening stations. Yep, you can put the actual circular whatsit on the doohickey that spins around and hear it make the music, little Johnny. All without clickety-clicking on the wee mouse-thingy.

BEST EVERYDAY KAN DO

Peruse the labels of say, a kitty-shaped exfoliating washcloth or exquisitely lacquered bento box at Ichiban Kan, and you’re likely to see a Good Housekeeping seal of approval-style label trumpeting that the item won a design award in Japan. At times it seems like everything wins a design award in Japan, then the realization sets in that no other country seems to have dedicated itself so fervently to assuring that the everyday things of life — from paper clips to cooking utensils — be attractive, eminently functional, durable, and well-designed. When we want to load up on the best of the quotidian (we’re particular fans of the rolls of plastic wrap for $1), we come here.

BEST GEEKDOM: THE GATHERING

It’s a constant nerd alert — not that that’s a bad thing — at Cards and Comics Central, a Richmond District shop where employees know the difference between vine whips and seed bombs and can explain why destroy effects don’t harm a cattank. Kids into Yu-Gi-Oh, Pokémon, or Magic will be overwhelmed by the shop’s vast selection. Parents will be overwhelmed at the price tag — you can spend more than $100 on a single card, though assorted decks (available for under $10) might keep the average young collector sated. Check out the back room for the real action — pale adults playing Magic with an intensity you won’t find at most Vegas poker tables.

What does it take to win a gazillion green business awards? It certainly starts with a great concept, a seriously vetted supply chain, and a commitment to spreading the eco-word. BEST FAIR FEATHERS

You think your head hurts from the plumage parade that alit on Dolo Park this year? Think of the feather-farm roosters and other avian amigos that have lost their lives to appease the current mania for quill jewelry and hair extensions. Happily, two gentle crafters have taken the torture out of the trend: Erykah Prentice and Martha Hudson started their accessories label Divine Dandelions for peace, not plucking. The two create their cascading earrings and fanciful headdresses from foraged feathers, selling them from a sweet little gazebo at festivals up and down the West Coast. Natural wooden tables, colorful blankets spread here and there, a goat’s head staring placidly down on wonder-covered shelves — Hayes Valley’s Reliquary could be a gaucho explorer’s treasure room. And — minus the gaucho part — that’s pretty much what boutique owner Leah Bershad has created it to be. In a perfect world, each visit to the Apartment would be a leisurely half-day treasure hunt. After a five-year effort by chain-wary neighborhood activists to keep it off the grand hippie boulevard, megachain Whole Foods opened at Haight and Stanyan streets early this year. Stepping into cobbler Suzanne George’s shop is like entering a hide-covered time warp. George crafts her clodhoppers in much the same way that shoes were made several hundred years ago. She works the leather by hand, stitching the pieces with thread and hammering it all together with actual nails. Not only are the shoes custom-made to fit every tootsie they encase, they are also unique pieces of art, nearly too lovely to take tramping on the dirty pavement. George shares her high-quality, low-technology workshop with Peter, a shoemaker originally from Italy who used to make sandals for Mother Teresa. Welcome to the Guardian’s Best of the Bay 2011! This is our 37th annual celebration of the people, places, and things that make living here such a great experience — from Best Burrito and Best Local Band to Best Strip Club, Best Shoe Store, Best Drag Queen, and beyond.

More than 15,000 of our readers voted in our 2011 Best of the Bay Readers Poll for their favorites in more than 200 categories. You’ll find the results inside — as well as 150 Editors Picks that highlight some Guardian favorites, old and new, that we think deserve special recognition for lighting up our lives this year. 

Our theme for 2011 is “Beautiful Rebels” — and inside this year’s Best of the Bay, we’ve highlighted eight of our favorite “beautiful rebels” who we think are helping change the Bay Area for the better.  Throughout its history, the Bay Area has attracted wave upon wave of people looking to create something unique. From Barbary Coast explorers to Belle Epoque, Jazz Age, and Beatnik free spirits, from hippies and queer and civil rights pioneers to tattooed 1990s swing kids and Burning Man visionaries, to today’s global tech innovators and their DIY, local, organic, small-batch counterparts. 

We seem to be living in a time when a certain conservatism and conformity reigns, when speaking out gets you pilloried in the comments section and big-box consumerism squeezes out charming idiosyncrasies. That’s why we wanted to take this Best of the Bay opportunity to celebrate the Bay Area’s proud perseverance in remaining the weirdest, oddest, most interesting and rewarding place in the world, somewhere where “freak” is a compliment and “out there” equals “gorgeous.”

In 1974, Esquire magazine asked us for ideas for its Best of the USA issue, which led to us publish the original Best of the Bay. Made by the people of the Bay Area for the people of the Bay Area, it’s our annual opportunity to celebrate the people and places that make this city great. We were the first weekly paper to publish a regular “best of” issue. Thirty-seven years on — and 45 years after we opened our doors — we’re still going strong.

Editing this year’s installment was a hoot. I shower grateful smooches on all my collaborators, especially my right-hand amiga Caitlin Donohue, creative wiz Mirissa Neff, amazing illustrator Renee Castro, photographer Ben Hopfer, the Guardian staff, and the ever-supportive Hunky Beau, my own personal Best of the Bay.

ABOUT THE ILLUSTRATOR

Like the Guardian, Renee “Lady Reni” Castro is native to the Bay Area — really. Born in Oakland, Castro’s heritage stems from the Ohlone Native American tribe. (You can’t get more local than that.) Her background serves as inspiration for much of her art, especially her subjects’ clothing and their deeply-rooted connections to the natural world. Her other influences for her illustrations in this year’s “Beautiful Rebels”-themed Best of the Bay include Mexican and Spanish folklore, broken-hearted femmes fatales, disheveled muses, and erotic heroines. Turning the tide

DANCE Joan Lazarus is one determined woman. This month, WestWave Dance celebrates its 20th anniversary. WestWave originated in 1991 as SummerFest by choreographer Cathleen Murphy; Lazarus joined her three years later, and the two women ran it together until Murphy moved on.

A few months ago Lazarus made noises about perhaps calling it quits. She was frustrated because in all the years of curating these annual menus of contemporary, often brand-new, choreography, “I could not make it work,” she says. Audiences remained small, budgets smaller.

From the beginning, Summerfest/WestWave had a clear idea of its role within the panoply of Bay Area dance. Most important was offering opportunities to choreographers who may not be on other presenters’ radar screens and who didn’t have the cash — or energy — to self-produce. The application process has always been wide open. This year, for instance, Lazarus programmed three unknown-to-her choreographers simply on the basis of the video they submitted. “I was intrigued by their work,” she explains.

It was imperative to present each choreographer under the best circumstances, which meant a professional presentation — lighting, sound, tech — in a professional setting, like the Cowell or ODC theaters. It was also important to create visibility, which usually translated into getting reviews. “It was only in year seven or eight that we started getting reviewed,” Lazarus remembers. “That’s when we noticed a tremendous jump in people who wanted to be in.” Still, the festival barely scraped by. Every year it was touch and go.

Lazarus sounds newly invigorated about starting another decade for this problem child of local dance that, nonetheless, has given many a choreographer — Katie Faulkner, Ben Levy, and Kara Davis among them — a push up the professional ladder. So what happened?

An experienced local presenter Lazarus consulted with told her that what she did didn’t work because it couldn’t be done. Audiences, she was told, will not attend contemporary performances on successive nights, so forget about trying to run this type of program as a festival. She should also forget about preferring world premieres (something Lazarus admits she was “prejudiced toward”) and insist instead that the artists present the best pieces they have. “You choose the artists based on their previous works and then let them make the decision on what they want to show,” she recalls from the conversation.

Last year — by programming WestWave on three monthly Monday nights — Lazarus took a first step in rectifying the situation. The overall quality of the three evenings turned out to be more than respectable.

For the 20th anniversary season she expanded the format. Evenings of solos, duets, trios, and more will again be shown on Monday nights: Aug. 15, Sept. 12, and Oct. 10 at ODC Theater.

This month, Lazarus wanted to feature some of the artists for whom WestWave had been an important early step. This weekend (July 22-24) at Z Space, she offered Seiwert — in 2007, WestWave had hosted her first full-evening concert — another program along the same lines. But Seiwert demurred, wanting her im’ij-re dancers to grow beyond her own choreography. So with Lazarus’ assent, Seiwert commissioned works from Matthew Neenan (Philadelphia), Adam Houghland (Cincinnati), and Susan Roemer (San Francisco).

For the second July program (July 28-29), the artists Lazarus selected asked to co-choreograph a single work. Lazarus told Manuelito Biag, Davis, Faulkner, and Alex Ketley to go ahead. Since each of them has a well-developed independent voice, this collaboration could prove fascinating. Later that weekend (July 30), Viktor Kabaniaev and Tina Kay Bohnstedt — Diablo Ballet’s strong in-house-nurtured choreographers — present an evening of their own work. Why? “Because they have never had one, and it’s about time,” Lazarus says.

One more change. Lazarus quit her daytime jobs so that she won’t have to steal an hour here and an hour there, often at midnight, to work on WestWave. “We’ll see how it goes, ” she laughs, ever the optimist.

Tech blogger takes on Silicon Valley

Critiquing the tech industry has to be one of San Francisco’s favorite events in the armchair Olympics – but usually the harangues are coming from my friend that can’t seem to hold onto his personal chef gigs. Incisive commentary about the social merits of Silicon Valley from within the tech community are hard to come by (maybe because they are all fully employed). 

Perhaps that’s why a critical blog post that tech news site The Next Web ran this week by normally ebullient reporter Hermione Way (who covers the start-up entrepreneur beat) set off so many alarms among her techie cohorts. Way, who I kind of think is a genius at being immersed in, and taking the piss from the tech industry, moved to Bay six months ago from the UK to interview start-up masterminds (we caught her before she’d even hopped the pond to learn about the life of a pro social networker), called out Silicon Valley on being motivated for all the wrong reasons:

I’ve heard pitch after pitch of the same technology and keep wondering why all these highly intelligent, well educated youngsters, many of whom have been educated in the best universities in the world (Stanford, Yale and Harvard) are not putting their brains to good use by solving real-world problems. Instead they’re building technology to solve trivial issues – like apps that show where to spot your nearest tofu cupcake and share it with your friends.

It’s an obvious critique that’s been levied by many people that haven’t met a fraction of the Internet entrepreneurs that Way has, but the post stirred up it’s fair share of wrath. 

Robert Scoble, who found initial fame as a Microsoft blogger and has been called a “technical evangelist”, pointed to financier Cynthia Ringo and Kevin Surace of Serious Material as exemplars of conscious technology movers. 

Over at Y Combinator, a start-up seed firm that operates news forums on its Hacker News website, some commenters thought the problem is that Way simply doesn’t understand what Silicon Valley is:

There isn’t a ‘problem’ with Silicon Valley, it simply exists like a beaker sitting over a bunsen burner. Over time different chemicals are available in the beaker and sometimes something magical happens, and sometime noxious fumes come out, but the place is an engine.

Of course, geographic locations don’t themselves create new techologies, socially-minded ones or otherwise — the people that live in them do. But to say that there is no culture of Silicon Valley – or hey, any place – is remarkably un-self aware. What is worked on, funded, and valued are trends that is agreed on by any community, even if, like Scoble, you can find exceptions to the rule. Here’s hoping that Way’s words will make techsters take a break from the coding-networking-developing grind to look at what they’re working towards.

Rejecting planned obsolescence with chiptunes and Front Line Theatre

This week, The Performant turns one, so please excuse me a moment while I stick a candle in my Molotov cocktail, tie it to this big red balloon, and send it soaring. In the oft-imagined dystopian future, this may well be how all our landmark dates will be celebrated, not with a whimper but a bang. We’ll all get drunk on a rare flask of artesian well water, and play pin the tail to the Womprat. As for the party music, it’s tough to predict what we’ll be listening to in the 22nd century, but it’s a good bet that electronics are going to figure heavily into the equation—if only as a way to use up all the obsolete 21st century e-waste sure to be still piled around.
 
Take chip music, for example.

This hardy little strain of underground electronica, also known as chiptune and 8-bit, has been pulsating away for over a decade in its own little corner of the dance floor, creating a sound that is both futuristic and retro. Walking into the DNALounge for the West Coast edition of Pulsewave, New York’s premiere, monthly chip music event, was akin to walking into an 80’s-era video arcade. Primitive, 8-bit graphics loomed large on the projection screen (courtesy of VJ Max Capacity), and the blip and zoom of familiar video-game sounds wedded to danceable beats were being DJed by Doctor Popular. Anybody who’s ever felt compelled to dance along to the theme music of The Super Mario Brothers would feel right at home at a chip music event, where much-cherished Game Boys serve as instruments, a lo-fi medium for creating hi-tech ambiance.
 
Of course, not every chip musician is limited to just 8-bits. San Francisco’s The Glowing Stars featured Lizzie Cuevas on guitar, and Matt Payne on baby blue drums (and canary yellow key-tar), who doubled up on the Game Boy, tweaking the output of their “traditional” instruments with the bloopety-bloop of that iconic device. Morgan Tucker, or Crashfaster , added ominous, vocoder-distorted vocals over dark-edged, almost gothic layers of chiptune before inviting East Bay hip-hop ensemble Spirits in the Basement to rap along. And headliner Bit Shifter, who’s been creating chip music for over a decade, blew the top off with an eminently danceable set of hard yet chirpy, post-EBM deftly coaxed out of his modified Game Boy box. Watch for more chip music marathons in the future as Pulsewave SF goes monthly. It definitely beats dancing alone at the video arcade.   
 
Meanwhile, Front Line Theatre, presenting their “verse-and-movement comedy, ‘Rare Earth’” at CounterPULSE, created an entire world from abandoned electronics. Called Unland, this desolate island was poisoned by chemical landfill leachings and decorated by enigmatic sculptures made of empty consoles, motherboards, and chicken wire (designed by Honey McMoney). An unexpected “Tempest”-style shipwreck brought a wayward Unlander home, and a thinly-plotted revenge scheme emerged from the rusty rubble. Combining modern-day slang, future dilemmas, and age-old conflicts, “Rare Earth” provided a view of the future not too fantastic to accept, but disquieting enough to want to stave off for as long as possible. Finding a use for all those outdated electronics would be a good first step. Someone get Bit Shifter on the phone.

SUPER EGO My ever-ahead Hunky Beau just introduced me to Na Nach techno — and I’ve been kinda freaking out about it, like I would about 3-D animated GIF nail polish, that you could upload Hipstamatic photo booth pics of you and your friends to, reenacting tacky 1980s movie dance montages, but happening on your nails, in 3-D, if it even existed, which it doesn’t, so why don’t you just get off your boring global warming-proving ass and do something fabulous about that, Mr. Scientist. I already know the weather’s weird. I want Footloose on my fingernails!

Na Nach is the name of a newish Hasidic Jewish subsect of followers of Rebbe Nachman of Breslov, the kabbalist mystic who lived 200 years ago. But unlike the larger Breslovian following, it has mobile rave units. Driving around Israel in white vans graffitied with giant Hebrew letters, the Na Nach stop at intersections and come tumbling out, blasting homemade electro trance, chanting “Na Nach Nachma Nachman Me’uman” (the Rebbe’s name spelled out), and dancing ecstatically in outfits that are part typical Orthodox dude and part Ali G. It’s basically a glorious logical conclusion to the whole “trance music as religious experience” thing. Of course the Sufis already got there centuries ago but, one suspects, without the aid of JBL 18-inch portable subwoofers and a pirated copy of Ableton Live.

The happy, energetic music and mood are actually pretty infectious. And the Na Nach, some of them former ravers and gangsters, have become so ubiquitous that hilarious parodies have started springing up — including one by the great gay Tel Aviv party Arisa (whose video flyers rule the homo Web right now.) DJ David Harness’s lovely, deep-yet-breezy party anchored San Francisco’s soulful house scene throughout the early 2000s, one of those joints where you could use the words “vibe” and “spiritual” and not feel like you were tossing up disco clichés. Yes, there were candles and, er, incense involved, and quite a few flowers tucked behind perked-up ears — hands snaking luxuriously up into the air as well. Now the party returns, finding a new biweekly Oakland evening home at the spacious Bench and Bar. Organic sounds, no labels.

The bloke from Bournemouth who was crucial in spreading the acid house gospel in the ’80s — and brought rave to Asia, with his storied seven-year stint in Hong Kong — has become a reliably sunny, techno-twisty force on Top 100 DJs lists and better global dance floors. Good, solid fun is had whenever he gets to town (and sometimes I just randomly prance around and drop to his xylo-yummy 2010 track “Wongel” in my head) so go already. Nikola Baytala, Rooz, and other locals work the build-up.

Guess it’s a battle of the Lees this week — luckily there’s some after-hours leeway to hit up both. This Lee comes to us from the Midwest via Los Angeles and London, were his chiseled looks and dreamboat eyes were at first as much of a talking point as his music. Luckily he overcame that crippling handicap to inject some bouncy tech-funk flavor into the trademark R ‘n’ B house of the Wolf and Lamb set. Call it the new New Jack Swing sound if you like. And you will like, especially when grouped at Public Works with Beats in Space radio host Tim Sweeney and my not-so-secret French house crush, Le Loup. (I love his little fuzzy mustache!)

Smooth sailing for developers

It’s a mad dash at San Francisco City Hall to put all the pieces together in preparation for the America’s Cup, the prestigious regatta that will culminate in the summer of 2013 along the city’s northern waterfront. But once that spectacle is over, the biggest impact of the event will be a massive, lasting, and quite lucrative transformation of the city’s waterfront by a few powerful players, a deal that has been modified significantly since it was approved by the Board of Supervisors.

As negotiations on the fine terms of the development agreements continue to unfold, the future landscape of a huge section of the San Francisco waterfront is in play. If the America’s Cup Event Authority (ACEA) — the race management team controlled by billionaire Oracle CEO Larry Ellison — aims high in its investments into port-owned infrastructure, it has the potential to lock-in leases and long-term development rights for up to nine piers for 66 years, with properties ranging from as far south as Pier 80 at Islais Creek to as far north as Pier 29, home of the popular dinner theater Teatro ZinZanni.

The possibility of securing long-term leases and development rights to Piers 19, 23, and 29 — provided race organizers sink more money into infrastructure improvements — was added to the deal in the last two weeks of 2010, just before San Francisco won its bid to host the world-famous sailing match. The possibility of obtaining rights to portions of two additional piers, 27 and 80, were also added at the last minute. Race organizers and city officials negotiated the final modifications after the Board of Supervisors signed off on the Host City Agreement on Dec. 14, 2010.

Not all board members knew that three additional city-owned piers were being added as possible extensions of the land deal, and those properties weren’t mentioned in any of the earlier documents that went through a public review process in the months leading up to the approval of the agreement. Yet Board President David Chiu was evidently appraised of how the last-minute negotiations were unfolding and he quietly offered his support.

On Dec. 22, 2010, Chiu sent a letter to Russell Coutts, CEO of Oracle Racing, the team that won the 33rd America’s Cup and is an integral player in laying plans for the 34th. “I understand that Mayor Newsom and the city’s team have been working directly with you since the board’s approval of the Host City Agreement to make the necessary adjustments and clarifications to the agreement to ensure it meets your needs. I am aware of these changes and support them,” Chiu wrote in a letter that was not shared with his fellow supervisors.

Quoting from a section of the agreement that explains that ACEA is ensured long-term development opportunities in exchange for funding improvements and upgrades, Chiu’s letter went on, “This section specifically applies to … Piers 30-32 and Seawall Lot 330, as well as Piers 26 and 28, and if mutually agreeable could apply to Piers 19, 23, and 29. To obtain the community’s support and agreement for future development rights to piers on the northern waterfront, you will need to invest in a strong partnership with the community … I am prepared to help facilitate that relationship.”

Former Board President and Democratic County Central Committee Chair Aaron Peskin, who has closely followed the America’s Cup land deal and has for decades been actively involved in land-use issues along the northern waterfront, interpreted Chiu’s letter to Coutts as a backroom deal.

“There is no question that the president of the board, without the authorization of the majority of the Board of Supervisors, went behind closed doors, out of view of the public, and committed to [long-term development] for three piers,” Peskin said, highlighting the fact that no other supervisors were copied on Chiu’s letter. “That he has done this unilaterally, without the consent of a board’s vote at a board meeting, is not good governance. If there’s one body that’s supposed to do all of its work for the public, it’s the Board of Supervisors.”

Chiu defended the letter by emphasizing the part that asked for a partnership with the community. “This was all within the broader framework of the Host City Agreement that we signed in the middle of December,” he told the Guardian when presented with the letter during an interview and asked to comment. “They had questions about, well, can we develop on these other piers? And what I said was, ‘Well, as I think the language here specifically says if mutually agreed upon … you could possibly do this.’ And we specifically said you’ll need to invest in a strong partnership with the community.”

He added that specific development plans would still have to be approved by the Board of Supervisors. Proposals for each parcel will be made in separate Disposition and Development Agreements, subject to board approval.

On hearing Chiu’s response, Peskin was still critical of the lack of transparency in this deal: “My position is, if it walks like a duck and quacks like a duck, it’s a duck.”

Meanwhile, an analysis prepared by Budget Analyst Harvey Rose in mid-March suggests that the final amendments did reflect new commitments for the city that go well beyond what was discussed publicly. “No city approval of the Event Authority’s selection of Pier 29 for a long-term lease is required in the agreement, as modified by the Mayor’s Office and other city officials,” the Budget Analyst’s report notes. “This entire provision … was not included in the agreement of Dec. 14, 2010 as previously approved by the Board of Supervisors.”

Brad Benson, special projects manager at the Port of San Francisco, explained the Pier 29 provision slightly differently. “The city would have to be acting in its reasonable discretion to say no,” he said, emphasizing that ACEA would have to invest well above the $55 million threshold to obtain rights to Pier 29.

At a time when a new era of civility is being hailed at City Hall, two elements of the city family are essentially agreeing to disagree on the broader question of whether the 11th-hour modifications to the deal resulted in a greater hit to city coffers than supervisors approved. While Rose stated in public hearings that the modifications would deal a greater blow to city revenues, City Attorney Dennis Herrera, a mayoral candidate, has stood with the Office of Economic and Workforce Development in his assessment that the changes did not significantly exceed the scope of what was approved by the board. Fred Brousseau of the Budget & Legislative Analyst chalked it up to “a difference in opinion,” reflecting “the auditor’s standard for materiality versus the city attorney’s.”

Legalese aside, it’s clear that the race organizers stand to gain some highly desirable waterfront property in exchange for investing in the piers and bringing an event to the city that is expected to generate substantial economic activity. If ACEA invests a minimum threshold of $55 million for infrastructure improvements, it can likely secure long-term development rights for Piers 30-32, a 13-acre waterfront parking lot where Red’s Java House is located, plus win the title to Seawall Lot 330, a two-acre triangular parcel along the Embarcadero that has been discussed as the site of a future luxury condo tower that has already cleared city approval for that use.

A high-rise next door to Seawall Lot 330, called the Watermark, currently has condos going for $1.2 million apiece on average, according to a calculation of online listings. Under the America’s Cup deal approved by the board, the port would have received 1 percent of each condo sale plus 15 percent of transfers or subleases made by ACEA. “Such required payments … have been entirely removed from the agreement as modified by the Mayor’s Office and other city officials,” the budget analyst’s report points out.

Waterfront real estate in San Francisco, always expensive, has recently soared to even higher values. According to a June 22 article in the San Francisco Business Times, Farallon Capital Management recently put up for sale a 3.36-acre parcel in Mission Bay zoned for life science and tech office space — and it’s expected to fetch around $90 million. This past April, BRE Properties shelled out $41.4 million for two Mission Bay residential development sites entitled for 360 residential units, and last year, Salesforce.com acquired a 14-acre Mission Bay property for $278 million, or $140 per buildable square foot.

By comparison, the $55 million that ACEA must invest to be granted a two-acre waterfront parcel on the Embarcadero, plus long-term rights to lease and develop an additional 13 acres across the street, sounds like a good deal. “We’re using an appraisal approach. It’s not going to ridiculously undervalue the property,” Benson said. Under changes made to the deal after the board signed off, base rent for Piers 30-32 will be $4 per square foot of building area. Rent for all other possible piers will be $6 per square foot of building area.

The ability to transfer city-owned Seawall Lot 330 outright to the ACEA is predicated on the approval by the State Lands Commission to strip that property of constraints placing it, like all coastal properties, in the public trust. Lt. Gov. Gavin Newsom, who pushed the deal as mayor, is one of the three members of that commission.

Under a provision in the agreement, the ACEA’s $55 million investment will be applied toward rent credits on city-owned parcels — and depending on how much the company puts in, that credit balance can increase by 11 percent every year. Benson described this as a typical arrangement, saying, “It’s not out of the line with other rent-credit deals the port has done.”

Two former mayoral advisors from OEWD, Kyri McClellan and Alexandra Lonne, have since gone to work for the America’s Cup Organizing Committee (ACOC), a nonprofit entity working in tandem with the city and the ACEA to secure financial commitments for hosting the race. Newsom has also been named ambassador at large for the America’s Cup effort.

Meanwhile, an OEWD budget proposal includes $819,000 in staffing costs for four management-level positions relating to America’s Cup planning. A refund is expected in the form of $12 million that the ACOC has committed to fundraise by the end of 2011, with an ultimate target of $32 million by 2013. So far, ACOC has only raised $2 million, but plans to seek higher donations once it gains tax-exempt status. “I think the $2 million is a really good start,” said Mike Martin, who transferred in February from the San Francisco Public Utilities Commission to OEWD to direct the America’s Cup effort. “They’re building a foundation for an effective pitch.”

For now, city departments are scrambling toward completing the environmental review process for the infrastructure improvements, expected to be complete sometime in November. “It’s incredibly compressed,” Martin said. “There’s a lot to be done in a very short time.”

Peskin, for his part, seemed be keeping a watchful eye on the unfolding America’s Cup plans. “What we, the citizens of San Francisco, have to watch out for is that we’re not being taken advantage of,” he said. “We’ve got to be vigilant that we don’t get taken to the cleaners.”

Fighting for control: A digital DJ throwdown this weekend at Public Works

This Sat/25, San Francisco will serve as host to an event that will have Guitar Hero extremists falling off their couches. Fresh off its success from its two year anniversary show in January, a group dedicated to showcasing live electronic musicianship is taking over Public Works, this time for the West Coast Championship Controller Battle, where electronic controllerists will battle it out in hopes of achieving a piece of controller glory.  

“It’s not a typical show,” says Rich “Rich DDT” Trapani, a producer of the event and co-founder of LoveTechSF. Trapani hopes that the controller battle will “bring the community [of electronic musicians] together and serve as a place to inspire each other.”  

For those not familiar with controllers: think completely digitalized turntables that mash up music with the help of computer hardware. They come in all shapes and sizes, each one fitted out with different types of knobs, switches, keys – some even have multicolored arcade game buttons that wouldn’t be out of place on an old Pacman or Frogger game system. 

With a controller, you can have the force of a drum kit at the mercy of your fingertips. A kick drum at your index finger, a snare at the ring finger, a hi-hat at the middle finger, and a snare at the pinky. It’s a heady sight, controllerists going at their machines – but don’t worry if you get stuck at the back of the club on Saturday. Trapani says there will be a video crew all over the clashing digitalists covering the action and projecting it on large screens for all to see. 

“People are learning a lot from the creative innovation and musicianship in this small period of time to really gain an understanding of what it means to be an electronic musician,” says Trapani. The controller battle will be a one-on-one throw down, tournament style elimination. Known and new electronic musicians from up and down the West Coast will be given two and a half minutes to electrify the audience — and judges panel — with their new and inimitable sets. 

LoveTech is working collaboratively with Controllerism.com and the Slayers Club DJ collective to produce this controller battle royale. 

“It’s going to be something that drives home the point that San Francisco is at the vanguard of music culture,” says Matt Haze, a Slayers Club DJ who will be spinning at the controller battle Saturday night. 

Also scheduled to perform at the battle are popular controllerists Ean Golden, and the electronic musician dubbed “the godfather of controllerism”, Moldover (co-founder of Love Tech and founder of Controllerism.com). The celebrity judges panel includes Zach Huntting Akazappan (Laptop Battle), J.Tonal (The Flying Skulls), and Laura Escude (Electronic Creatives).

Two bike photo projects show love for the movement

We’re in a moment of bike love. Bikes are hot: in SF the weather’s hot, the Bicycle Music Festival‘s coming up, an extended network of bike paths is on their way – and around the world, there’s a lot of energy surrounding the rise of two-wheeled transport. It’s an important time for bicycles, so let look at how it’s being documented. 

One way: Matthew Finkle and Brittain Sullivan are the authors of a book called – yes – I Love My Bike (Chronicle Books, $16.95, 160 pages) that recently landed in our Guardian mailbox. Finkle and Sullivan, the book’s intro tells me, met on a bike ride on a summer night in Boston and subsquently pedaled across the country with each other, snapping flicks of their bikey buddies along the way.

Theirs is a photo book of bikes and their riders, smattered with terse little quotes from all the pretty things (“when I get pissed off I build gold bikes!” the handlebar-mustachioed, booze-toting Erik Noren of Minneapolis’ Peacock Groove Cycles enigmatically proclaims). America’s lookin’ real good on our bikes, according to I Love My Bike — everyone’s got a bicycle fit to induce heavy breathing among the so-inclined.

I have to admit, I started getting a little hot and bothered over some of the (bike!) specimens – there’s a yellow banana seat cruiser on page 109 for which I die, and I know that according to the bike snob gods I’m not supposed to like those five spoked plastic fixie rims anymore, but Daniel Mueller of Boston’s pink and powder blue creation… I don’t care, want.  

I Love My Bike: Wall to wall wheel walls 

When I shut I Love My Bike, I did so with the impression that the US is a solid mass of trendy, creative (mainly) young people — on bikes. I like those kinds of people – some might say that I am one myself. The book, presented as an aspirational showcase of hipster and high performance bike fashion, works just fine. 

But Finkle and Sullivan need to holler at whoever’s writing their back cover blurb. “Throughout their travels they met cyclists of all kinds…,” it rather hyperbolically shouts. Or maybe they met cyclists of all kinds, but they didn’t publish any photos of them – I’m didn’t see any families in there, and certainly no one with a junker bike that isn’t a hard-to-find, check-my-steez brand of junker. This is a book of bikers that are just a few freeways from having a big ass social ride to a BBQ of local, organic edibles in a park somewhere.

I think that people who bike are more complex than that — in a good way. For a different take on a bike photography project, head south. And east. Really far in both of those directions. 

There you will find South Africa’s Bicycle Portraits, a photo series that was started by Nic Grobler and Stan Engelbrecht to highlight the brave, self-propelled souls on roads where cars aren’t always the friendliest neighbors for meat puppets (to borrow a favorite term from David Byrne’s Bicycle Diaries). You’re not getting the idea that everyone depicted in Bicycle Portraits is a brother from a different mother — but you are getting the feeling that the biking movement is moving away from the “ain’t it cool?” model of awareness-building to the “ain’t it necessary?” school of thought. 

You can’t scroll through Grobler and Engelbrecht’s website without realizing that biking in South Africa may well be a lifestyle, but it’s not a single lifestyle — people aren’t just riding bikes because it’s fun, hip, or social, but because it’s the mode of transportation that makes the most sense for them. Bicycle Portraits purposefully paints a country of bikers as a diverse, important group of citizenry.

Rich people, poor people, old people, kiddos. Ashton May’s black township cruiser, Loza Philani’s well-ridden Raleigh (“my bike is like oxygen to me – it keeps me alive,” he says), and Brandon Searle’s high tech Durban Cannondale. The two also collected in-depth interviews with each subject to help explain how bikes figured in each of the lives they documented.

After two successful Kickstarter campaigns, the Bicycle Portraits team is now accepting pre-orders for what is sure to be a phenomenal book. (Swoop.)

In a land such as our own when bike riding all too often is stereotyped as the domain of flippant and sullen (does that work?) trendoids who refuse to “mature” into taking crowded public transportation and gas-guzzling automobiles, projects like Bicycle Portraits seem incredibly important. If we have proof in front of our eyes that bikes are helping people lead lives that help the planet, city governments are way more likely to invest in bike systems, parents are more likely to encourage their wee ones to take to two wheels, and people who don’t fit the hipster stereotype are more likely to pedal off into the sunset. Fashion is fun, but fashion alone can’t influence urban planning. 

We do the movement a disservice if we paint ourselves as the sole face of biking in today’s cities – but of course, the diehard dandies among us are always going to Love our bikes. Damn Carolyn Ngo of San Diego, where’d you get that metallic blue handlebar tape?

 

Wild is the wind

SUPER EGO “I remember the last time I saw Nina Simone, it was just after the Bush-Gore election fiasco. She was maaad,” graciously loquacious jazz chanteuse Kim Nalley told me over the phone when I asked her about the High Priestess of Soul’s relevance today. “Here was this woman who had been there through so many stages of the civil rights struggle, fought for voting rights in Mississippi, been there through all of that — and then to hear about black communities, Jewish communities, where the votes just disappeared …

“Well, she wasn’t having any of that. She told us we had to always keep up the fight, keep the fire going, and never let go. What was gained in one generation could be completely wiped out in the next. And all the while she was playing the most spellbinding music. I think that’s her angle on now”

Golden-voiced and full of fierceness, Ms. Nalley, a longtime (but not too long) Bay Area phenom and former owner of Jazz at Pearl’s in North Beach, intends to keep that message alive for five straight weeks at the Rrazz Room — and sing the sugar out of a Nina Simone set list that runs to 44 songs, augmented with tales of the activist diva’s life and accomplishments. If just thinking about doing all that makes you draw a breath, add in that Nalley is finishing up her Ph.D. in history at UC Berkeley, teaching jazz to grade school kids, and preparing to embark on a string of international tours and recording projects. Plus she’s catching up on all four seasons of Mad Men. Did I mention she’s gorgeous and actually exists?

She’s also well aware of the hold almighty Nina still exerts on the dancefloor imagination — from the famous, or infamous, Verve Remixed series of the early ’00s, to more recent sample-based efforts like those of Massive Attack, Gui Boratto, Ark, and this spring’s rather unfortunate minimal-tech hit “Sinnerman 2011” by Sean Miller and Daniel Dubb, which apparently took two people to make. (Civilization has so far escaped an Auto-Tuned strip-rap version of “See-Line Woman” or Deadmau5’s “Young Gifted and Black” but I could easily see Nicki Minaj as all “Four Women” at once.)

Groupon’s secret

A San Francisco-based bus tour operator who relies on the Internet to drum up business has filed a class action suit against Groupon, alleging that the deal-of-the-day website uses false advertising, or bait-and-switch tactics, to get customers to its site.

San Francisco Comprehensive Tours, LLC, which does business as San Francisco Shuttle Tours and Wine Country Tour Shuttle, originally filed suit March 17 in the U.S. District Court, Northern District of California “to stop false and misleading business and advertising acts and practices employed on Google.com by Groupon, Inc.”

In essence, the tour company claims that Groupon is dominating Google searches with offerings for discounted local tours — of, say, Alcatraz — that don’t actually exist.

On April 19, SFCT amended its complaint into a class action suit. The amended suit includes “all persons and entities in the United States who purchased Internet ads with Google for the purpose of advertising local tour company business information and whose tour businesses, including the cost of advertising on Google, have been affected by the false advertisements of Groupon which claim to provide discounted offers for tours but actually provide no such offers.”

Attorneys for Groupon have asked for an extension until June 13 to respond to SFCT’s complaint. Representatives for Groupon told the Guardian they can’t comment on the case.

SFCT’s attorneys claim that Groupon is arguing that this shouldn’t be a class action suit because everyone’s complaint is different.

“They’re spamming the Internet with false advertising that affects everyone’s ability to do business, so this is tailor-made for a class action suit,” said SFCT’s attorney Steve Williams of Cotchett, Pitre & McCarthy in Burlingame. “It’s not easy to take on Groupon now that it has gotten so big and can afford top-notch lawyers.” In other words, it could take a group to take on Groupon.

The suit comes as Groupon, which launched in Chicago in 2008 and now claims to have 70 million subscribers as well as annual revenues of $700 million and an estimated worth of $12.7 billion, prepares to go public. Investors are trying to figure out if Groupon has a sustainable business model.

Last December Groupon fueled speculation that it would offer an initial public offering (IPO) when it rejected Google’s jaw-dropping $5 billion-plus takeover bid. Spurned, Google responded by launching Google Deals, a Groupon clone, in Portland, Ore., this June and announcing plans to expand into San Francisco and other U.S. cities later this year.

But as Forbes magazine noted last August, Groupon founder Andrew Mason has “managed to build the fastest-growing company in Web history.” Groupon’s meteoric rise has been attributed to Mason’s decision to combine a familiar concept with a novel idea: customers only get Groupon’s deeply discounted deals if enough customers pay up in advance for the deal that day.

 

A BAIT AND SWITCH?

SFCT is accusing Groupon of manipulating ad space that it buys from Google to funnel visitors to its site and collect data about these visitors — while SFCT and other tour companies lose customers and have to spend more money on online advertising.

This isn’t the first time Groupon has been sued since it was launched. But the bulk of those cases revolved around claims that Groupon’s “Daily Deal” gift certificates have illegal expiration dates. By contrast, SFCT’s suit is about Groupon hurting other businesses through manipulating Google’s AdWords program, which is Google’s main advertising program and main source of revenue.

“It’s the means that Groupon uses that is harming legitimate businesses. But they argue that it’s the Internet, it’s all new, and therefore the rules don’t apply,” Williams claimed.

Even though Google has not been sued in this instance, Eric Goldman, an associate professor at Santa Clara University School of Law and director of the school’s High Tech Law Institute, said that much of SCTF’s complaint is as much an indictment of Google’s platform as it is of Groupon’s practices. “Even though Google hasn’t been sued, I wonder if Google has or will make changes to its ad platform in response to the allegations in this complaint,” Goldman said.

Google spokesperson Diana Adair told the Guardian: “Unfortunately, we’re not able to comment.”

Williams claims that Groupon is gaming the algorithm that underpins Google’s AdWords program, which uses a combination of the number of click-throughs to a website, the closeness of an ad’s wording to an Internet user’s search terms, and the amount of money businesses are willing to bid on specific keywords to rank search results on Google.

“Groupon can’t say it’s just an AdWords problem,” Williams said. “It’s a manipulation.”

In its suit, SCTF claims it successfully bid on keywords such as “San Francisco tours,” “Alcatraz tours” and “Napa wine tours” for years. Then, in September 2010, Groupon started bidding on these terms as well — and though it rarely offered any discounted Alcatraz tours, it began to rank high in search results, driving up SFCT’s ad costs.

The suit notes that one time, in response to the keyword “Alcatraz tickets,” Groupon’s ad copy read “Alcatraz tickets — one ridiculously huge coupon a day: Do Alcatraz CA at 50 to 90 percent off.” Groupon’s actual ad that day was for discounted acting lessons.

“But they don’t care because they are trying to direct as many people as they can to their website,” Williams claimed.

Williams said he believes he can show that from the moment Groupon started placing ads for tours it didn’t sell, SFCT has suffered financially. “For someone like the plaintiff who is not about to put out an IPO, the frustration is that Groupon is funneling people into their direct mail campaign to develop huge databases and monitor what people like to buy so Groupon can target those people in future,” he said.

Williams told us he thinks he knows how Groupon will try to defend its strategy. “They’ll probably say that there is nothing wrong with what they are doing because if a business want to attract people to its product, it can talk to them about other products,” he said.

But he doubted they would try to blame it on Google. “Google would say that Groupon is taking advantage of AdWords,” Williams explained.

He sees Groupon’s strategy as a “bait and switch” tactic that’s illegal under the federal Lanham Act and California’s unfair competition and false advertising laws. “If I did this in a newspaper’s classified advertising section, it would be wrong. But the way Groupon looks at it, the normal rules don’t apply because it’s doing this online,” Williams said.

 

TRUTH IN ADVERTISING

Williams also noted that Groupon hasn’t disclosed all the other lawsuits it’s facing. “They view this as a pesky little thing. But most companies, unless the suits are patently without merit, will err on the side of caution, believing it’s better to disclose than fail to disclose,” he said. “Or maybe they are thinking, ‘Soon we’re going to be making $30 billion, so who cares?'<0x2009>”

Goldman notes that SFCT’s class action adds extra complexity for its lawyers. “Groupon will likely try to prevent the class from forming in addition to attacking the substance of the arguments. This is not a quick-and-easy win for the plaintiffs. In many cases, companies like Groupon decide to settle rather than fight because it’s a costly defense, even if they ultimately win.”

“The starting point of this suit is simple enough, namely that businesses need to tell the truth in advertising,” he said. “The complaint alleges that Groupon wasn’t telling the truth because it says X in its ad but when you get there it says Y, which has nothing to do with X.”

Goldman also predicted that, to the extent that SFCT’s suit is truly about an algorithm problem, it won’t be helpful to Groupon. “But that doesn’t mean the plaintiff will win,” he added, noting that establishing false advertising is tricky.

The plaintiffs will have to establish that their parties are competitive and that their businesses were harmed, Goldman said. He also observed that this particular class action suit points to a broader range of questions about the legitimacy of Groupon’s business practices and problems with Google’s AdWords platform.

Goldman pointed to a lawsuit filed June 7 against Amazon suggesting that Amazon had an algorithmic tool for buying ads and that perhaps the tool had gone awry. In that case, Maxfield, a New York City company that markets and distributes the magnetic desk toys called Buckyballs, alleges that beginning May 5 when people searched online for “Buckyballs,” an ad popped up for Buckyballs at Amazon. But when customers clicked on this ad, they wound up on a website that purports to be a listing for Buckyballs but is actually an ad for Maxfield’s competitors’ products.

Goldman also said there is a growing trend of plaintiff law firms feasting on Internet companies, especially in Silicon Valley. “They are watching for these companies to make a mistake and are pouncing on them. It’s possible that suits are mushrooming into class action suits because someone is looking to get more money,” he said.

But in SFCT’s case, Goldman noted, “the plaintiff’s story makes sense.”
