Pushing back against Newsom’s leaked memo war

Remember how Mayor Gavin Newsom leaked a confidential City Attorney memo about the implications of Sup. David Campos’ proposal to extend due process to undocumented youth?

And how Newsom made everyone else wait two weeks before deigning to release said memo, even though he told the Guardian that he had every right to waive his attorney-client privilege and distribute the Campos memo to whomsoever he pleased?

Well, this week a number of folks are preparing to file complaints with the Sunshine Taskforce a) about the Mayor’s Office’s selective release of this memo and b) his office’s subsequent refusal to release any other communications related to the leak.

And today, a group of civil rights organizations released a legal brief that responds to City Attorney Dennis Herrera’s leaked memo on the city’s immigrant youth policy. (You can read the brief in full here.)

Also today, Sup. David Campos participated in a tele-press conference in which legal experts and professors explained why Campos’ proposed amendment, which has an Oct. 5 hearing before the Board of Supervisors’ Public Safety Committee, is legally tenable and defensible.

And along the way, Campos and these experts, who included Angie Junck of the Immigrant Legal Resources Center, Robert Rubin of the Lawyer’s Committee for Civil Rights, Julia Mass of the American Civil Liberties Union (ACLU) of Northern California, Professor Bill Ong Hing of UC Davis Law School and Angela Chan of the Asian Law Caucus, succeeded in debunking a number of myths about the Campos amendment.

As the brief explains, the Campos’ proposal, “will allow immigrant youth to have their day in court and be heard by an impartial judge, ensuring due process is upheld for all of San Frnacisco’s youth,” “ensure that families are not torn apart because a youth is mistakenly referred for deportation,” “encourage cooperation between law enforcement and immigrant communities by reestablishing a relationship based on trust and therefore increasing public safety,” “lessen the risk that the city will be liable for racial profiling, unlawful detention and mistaken referrals of U.S. citizens and lawful immigrants for deportation,” and “bring the city’s juvenile probation practices into compliance with state confidentiality laws for youth.”

And as today’s brief further explains, the Campos proposal won’t prevent referral to ICE of youth who have sustained felony charges and won’t put the sanctuary ordinance at risk.

“The sanctuary ordinance has stood strong for twenty years, and the proposed amendment strengthens the ordinance by taking steps to bring the city’s practices more into compliance with state juvenile justice law,” states the civil rights brief, which was prepared by the Asian Law Caucus, Legal Services for Children, Lawyer’s Committee for Civil Rights of the San Francisco Bay Area, Immigrant Legal Resource Center, San Francisco Immigrant Legal & Education Network, and the San Francisco Immigrant Rights Defense Committee.

“In short, the legislation is a measured step in the right direction that will help restore accountability and fairness in the City’s treatment of immigrant youth.”

And as Campos told reporters today, his proposed amendment, “ is something we drafted very carefully in close consultation with the City Attorney’s office.”

William Safire — an appreciation (of sorts)

William Safire was wrong about Vietnam. He was wrong about Watergate. He was right about poor Bert Lance, but wrong about Jimmy Carter. He was very, very wrong about Saddam Hussein, 9/11 and the Iraq War. He was, as the Telegraph of London says, “tall, dishevelled, slouching and dour.”

But Lord, what a good writer.

His conservative columns sparkled with style and wit — and often, with intelligence (that factor so utterly missing from the right wing of American politics today). I read him regularly, not just his language columns (which got more dreary as he aged), but his political commentary, which was sharp up until the day he retired from the New York Times op-ed page.

And while he was often horrendously wrong and politically awful, he was pretty consistent. After complaining repeatedly about the climate of secrecy in the Bush Sr. administration, he made it very clear in 1992 that a president who refused to accept sunshine in the White House was unacceptable and that “this lifelong Republican” was going to vote for Bill Clinton.

(He later chided Barbara Streisand for refusing to take his phone calls. “She told me if I voted for Bill Clinton, she’d [grant an interview.} I did; she didn’t.”) And, of course, he famously turned on the Clintons, referring to Hillary as a “congenital liar.”

And unlike a lot of conservatives of his era, he was willing to change with the times. By the late 1990s, he had become pro-choice on abortion, and once commented on a rally to save Roe v. Wade: “Nothing warms the heart of an old conservative as much as seeing thousands of protestors stare decisively at the Supreme Court and demonstrate in support of the status quo.”

Back in 2003, he opened the door to conservatives accepting same-sex marriage (“I’m a ‘libcon.’ To that small slice of the political spectrum called libertarian conservative, personal freedom is central,” and if he were still writing today, I’m pretty sure he’d be out front on that issue (and on allowing gays in the military).

So I’ll miss the crusty old right-winger. He did a lot of damage, and when he first started writing his column in 1973, as a former Nixon speechwriter, he was an apologist for an administration that was pretty much indefensible. But he was thoughtful and somewhat open-minded and sharp and funny and creative. There are no conservative writers who come even close today.

Canadian cinemania: one critic’s take on TIFF ’09

There were quite a number of exciting films at the 34th annual Toronto International Film Festival, though attending 21 features and 20 shorts in five days also involved some disappointments. Japanese director Hirokazu Kore-eda’s Air Doll somehow dropped the ball in every which way, throwing around interesting concepts involving a sex doll who comes to life (a la The Velveteen Rabbit), but it ended up leaving me longing for Michael Gottlieb’s 1987 politically incorrect gem, Mannequin. Or Fridrik Thor Fridriksson‘s The Sunshine Boy, an Icelandic documentary about Autism around the world. Though it used Bjork and Sigur Ros on the soundtrack, it felt like an infomercial for public access. (To be fair, I saw the version with an Icelandic narrator and not the newest version with Kate Winslet reading the cues.)

Some films succeeded in minor ways, including George Romero’s fifth entry in his zombie oeuvre, Survival of the Dead. While enjoyable, this one seems to lack the political immediacy of his previous entries, including his underrated Diary of the Dead (2007). Michael Moore’s (last?) feature Capitalism: A Love Story had some brilliantly ironic moments — as always, interspersed with his typical forehead-slapping activism (do you really have to continue using minimum wage-earning security guards at major corporations as the butt of your wacky antic jokes?). It felt a bit scatterbrained. Still, the film is well worth watching and even won the runner-up audience award for Best Documentary.

The creator of the original British version of The Office had his directorial debut with The Invention of Lying. Ricky Gervais’ cynically hilarious, cameo-packed laugh-fest sadly ran out of steam during its last act, but no matter. What’s most important here is the sucker-punch moment that has Gervais flexing dramatic skills so poignantly that it literally brought tears to the entire audience. (On a side note, why doesn’t Gervais ever end up kissing his leading ladies? Is this a conscious choice to counteract the likes of Woody Allen or Vincent Gallo or is it truly due to a low-self esteem?)

Todd Solondz’s Life During Wartime, Bong Joon-ho’s Mother, and Claire Denis’ White Materials all delivered solid entries, proving these directors know their craft and do it quite well — though depending on how much you may have enjoyed their previous films you may be left wanting a little less or a little more.

Metro Cafe

A half-score (or so) years ago, there came to the border country between the upper and lower Haight a restaurant called Metro Café. The place was an offshoot of Baker Street Bistro, and, like its progenitor, it was rather wonderful and quite affordable. In the mid-aughts the restaurant morphed into Metro Kathmandu, which served a Nepalese-Indian menu. The change was improbable, but the food was just as good in its way. Now, after a too-short run, Metro Kathmandu has disappeared, only to become … Metro Café again.

Actually, it hasn’t altogether disappeared: the look of the dining room remains the same, with a tendency toward red and umber tones and fanciful light fixtures that look like bubbles of colored Plexiglass that someone sawed off the bottoms of. Nor is it quite accurate, perhaps, to speak of the new Metro Café as a return of the original. There are points of similarity, yes, mainly in the emphasis on a three-course prix-fixe menu. At $25, it’s quite a bit more than in the good old days (on the order of $10 more), but what isn’t? It’s still a good deal, especially when you consider that you can have any starter, main dish, and dessert. And no surcharges for the fancier stuff like New York steak or duck confit. I call that sporting.

But the food doesn’t seem to be quite as pointedly French as the last time. The pediment of Chef Jacques Rousseau’s style is unmistakably Gallic — he offers snails, and need we say more? — but the menu is Californian, not French. There are dishes here you’d have a tough time finding in Paris — and not just macaroni and cheese ($8), although Metro’s version is quite tony, with cheddar, Swiss, and Parmesan mingling under a thick crust of garlic-bread crumbs. The only thing missing was a bit of salt, but this was easily added from a shaker already on the table. We liked the serving dish, an earthenware crock in the shape of a paddle.

Equally in a Ameri-Cali, if more elevated, vein was a plate of grilled squid ($6.50), accompanied by white beans, bits of frisee and chopped black olives, and a beguilingly fragrant olive oil infused with preserved lemon. The pieces of squid were beautifully tender — no small trick; squid overcooks and toughens easily — while the lemon oil cast a spell like sunshine over everything.

And I do not think you’d easily find in Paris any preparation to match the baby back ribs ($15), with their glaze of honey, cardamom, and coffee — darkly sweet but also a little smoky, like a demitasse of espresso with a half-cube of sugar. Since pork is naturally sweet, a sly mix of sweetness and smoke produced a complex harmony with the meat. The ribs arrived atop a generous slathering of green lentils, properly cooked al dente.

As for the ultimate French treat, les esgargots ($7): they came discreetly swaddled in pastry pockets that looked like empanadas. There was plenty of garlic on hand and, on the floor of the plate, a garish pool of red-pepper purée; these were quite useful flourishes if you needed some distraction from the advertised main ingredient. But the real main ingredient turned out not to be snails but pastry.

Duck confit ($16) is another quintessentially French dish, and Rousseau’s kitchen handles it with aplomb. The result: tender, juicy meat inside appealingly crisp, golden skin. The potatoes landaise did not particularly impress, however; instead of the traditional Pyrenees-style version, of potato cubes fried with onion, garlic, and ham, Metro offered what appeared to be handful of roasted, and underseasoned, potato quarters. An underseasoned potato is a piteous thing, naked and flabby, even if there’s some red-pepper purée on the plate for consolation.

The dessert list is the most purely French sector of the menu. Tarte tatin? Check. It costs $6 and is distinguished by large chunks of apple that are the shape of Gary Oldman’s strange, puffy hair in Dracula. The apple also retained some of its texture — a plus — but I did suspect the kitchen had used big, sweetish apples (maybe some sort of Delicious) rather than one of the smaller, sourer, denser varieties that, in my experience, work better in this tart.

The one non-French note struck among the desserts involved the chocolate cake ($6), which turned out to be a layered mousse cake that included a stratum of raspberry preserves. Sort of a variation on the Viennese specialty Sachertorte, with the raspberry preserves substituted for apricot. I like these kinds of small flourishes, which go a long way toward lifting the pall of enslavement that can sometimes hang over French-influenced restaurants in our corner of the New World. If, at some point, Metro Café becomes Cosmo Café, I would gladly clink my champagne flute.

The color of cooked crawfish isn’t red, exactly — more a garnet. If it were a wine, it would be a medium-bodied pinot noir. Certainly it would never be mistaken for cooked lobster, which (pace Red Lobster) isn’t red at all, but more of an inflamed orange. You see plenty of crawfish being rushed from the evening kitchen at Red Crawfish in the Tenderloin; the crustaceans make the journey in shallow white bowls and reach tables full of eager patrons who’ve fitted themselves out with plastic bibs in anticipation of mess.

Red Crawfish, like the Green Hornet, has something of a dual identity. By day it’s a quasi pan-Asian place tending toward Chinese and Vietnamese favorites. But as the sun sets, it dons a Cajun guise, and a menu filled with familiars like five-spice chicken and beef noodle soup suddenly develops a bayou section that includes (besides crawfish) treats such as gumbo and Cajun fries.

The dual-identity restaurant is a rare phenomenon, but not an unknown one. Some years ago there was a spot on lower Haight Street that appeared to be an all-American café by day but turned into a Senegalese joint on certain nights of the week. And, in the present moment, we have Coffee Bar, which daytimers know as a coffee bar but becomes host to Radio Africa Kitchen several nights a week. Red Crawfish is close kin to these spots, but it has the additional charm of joining compatible, if unlikely, cuisines without fusing them. The Cajun dishes remain Cajun and the Asian dishes Asian, but they do make a nice harmony: a communion of spiciness.

The cathedral in which this union takes place is unprepossessing, in true Tenderloin fashion. The dining room is deep and very narrow — a half-storefront — with a long mirror along one wall to give the illusion of greater spaciousness. Ceiling fans do offer a hint of New Orleans. But the furniture, though plain, is well-made, the tabletops are clean, and you are greeted and seated promptly when you step through the door.

The Cajun dishes are dialed up according to the patron’s preferred level of heat (on a four-step scale) and style of seasoning. For the seafood combo ($13.99), for instance, you choose among lemon-pepper, garlic butter, and red crawfish flavor palettes. The last turned out to be a deep red, slightly oily, iridescent soup flecked with dried chili and giving a faint charge of fruity acidity; had it been spiked with a mild vinegar? In this shallow pond frolicked shrimp (partly shucked), oysters (fully shucked), and chunks of calamari and white fish. The second-lowest level of heat ("spicy") proved to be more than sufficient, while the pre-shucking, while probably indicative of slackerdom on our part, also made the dish much easier to eat and enjoy and at the same time limited the mess. That’s a lot of upside.

Cajun fries ($3.99 for a semi-gigantic plate) were fine but ordinary. We did detect a faint dusting of cayenne pepper on them, but not enough to make a serious impression. Better, for flavored-up starch, were the garlic noodles ($6.50). They would have gone brilliantly with the gumbo ($10.99), but the gumbo was somewhat late in arriving. In fact, it arrived last and, like a folk act following a death-metal group, its luster was at first somewhat dimmed by the potency of the seafood combo that preceded it.

But the gumbo found traction after a bite or two and was thick and satisfying even without rice — or garlic noodles. The thickener was okra, whose flavor has a ghostly bite, and the result wasn’t particularly pretty: a bowlful of lumpy gray-green sludge. The lumps, though, consisted of delectables such as shrimp, chicken, and pork, and added enough heft to make the gumbo into a (potential) meal in itself.

An unexpected rival for meal-in-itself (although not heart-healthy) honors might be the beignets ($4.50), a quartet of deep-fried pastries shaped like little top hats and served with a pair of massive ice-cream torpedoes. The ice cream was vanilla, and the torpedoes were cross-hatched with chocolate sauce, and that alone would have been enough for two people — even two hungry, greedy people bewitched by the crunchy fattiness of the beignets. (To describe these as "deep-fried" does not quite capture the reality.)

In sunshine — or fogshine, as the case may be — the restaurant slips into east Asian character. Salt and pepper calamari ($5.50) are batter-fried and presented with a nuoc nam-based dipping sauce whose sharpness helps cut the grease. Mixed vegetables with tofu ($5.95) sets a low mountain of broccoli florets, carrots, cabbage, and tofu cubes on a huge pediment of white rice. The vegetables are crisp and fresh; the soy-heavy brown sauce, a little bland. Five-spice chicken ($7.50), on the other hand, with egg rolls and vermicelli, is enhanced with mint, which brings both color and sweet breath to the rescue. That color is green, by the way. *

Every poor and working class community in San Francisco has learned the hard way that its interests are at the bottom of the list as far as City Hall is concerned. At the top of the list are the banks, real estate interests, and large corporations, who view San Francisco not as a place for people to live and work and raise families, but as a corporate headquarters city and playground for corporate executives. By using their vast financial resources, they have been able to persuade local government officials that office buildings, hotels, and luxury apartments are more important than blue-collar industry, low-cost housing and decent public services and facilities.

Sound familiar?

It’s more than 30 years old.

Back in 1974, more than 50 San Francisco community groups — from Bay Area Gay Liberation to the Telegraph Hill Neighborhood Center, from the Federation of Ingleside Neigbhors to the San Quentin Six Defense Committee, from the Golden Gate Business and Civic Women’s Association to the Socialist Coalition — started meeting to develop a plan to take back the city.

It culminated with a Community Congress, on June 8, 1975, at Lone Mountain College (now part of the University of San Francisco). More than 1,000 people attended, and they drafted a remarkable 40-page document that outlined an alternative political, economic, social, and environmental agenda for San Francisco. The movement led, among other things, to the advent of district elections of supervisors (a key element in the platform) and the rise of active community-based organizations in this city.

Calvin Welch and Rene Cazenave, the veteran activists who run the San Francisco Information Clearinghouse, were among the organizers. They found the old manifesto recently and sent it out to a few of us by e-mail. I’ve posted it on the Politics blog. It calls for rent control, a sunshine ordinance, a health commission, full-time supervisors (who were to be paid $20,000 a year, the equivalent of $86,000 today), cable-TV coverage of the supervisors meetings, a mandate that developers build affordable housing and a feasibility study on public power. In fact, much of what the left has achieved in San Francisco in the past three decades is outlined in the Community Congress document.

(The congress also called for decriminalization of victimless crimes, including public inebriation, a guaranteed annual income, the abolition of the criminal grand jury, and some other things that didn’t quite come to pass.)

I mention this not only because it’s a fascinating historical document but because Welch and Cazenave think it’s time for a new Community Congress. Their draft agenda refers to a New Deal for San Francisco, and they’re talking about holding a series of meetings culminating in a major session sometime next year.

It’s tough to get the San Francisco left to come together on issues, even harder to build a broad-based organization that can push an agenda. Sup. Chris Daly tried several years ago, but the San Francisco People’s Organization never got the traction many of us had hoped for.

But although the progressives have accomplished a tremendous amount in this city, and have come a long way since 1975, the need is still there.

"San Francisco’s downtown corporate and banking interests and their representatives in city government are attempting at a local level to shift the burden of the current economic and political crisis ever more fully onto the backs of the poor and working people of San Francisco."

That was then. Today, Welch and Cazenave write, "San Francisco stands at a crucial junction brought about by the collapse of the real estate based speculative bubble and the related steep reduction of city revenue resulting in cuts in funding important programs and services … There needs to be a general coming together of community groups to articulate a set of policies able to be implemented at the local level which seek to maximize community control over the provision of critically needed health and human services and beneficial community development and to maintain a vital public sector."

Sounds like a plan. *

Rhetoric and reform at SFPD

EDITORIAL We’re glad to see San Francisco’s new police chief, George Gascon, is talking about reform. He’s talking about opening up the mediaphobic culture at the SFPD, bringing in new blood at the management level, shifting schedules so more experienced cops are available at night (when most crime takes place). He wants to focus the discipline process on the most serious departmental offenders — the handful of officers who are responsible for the majority of the misconduct problems.

Those are, generally, good signs. If he’s serious about changing the moribund, sometimes corrupt, and generally toxic climate in the department, though, he’ll need more than promises. Over the next few months, he needs to take action on a few key fronts.

Send a clear message about discipline. The weakest link in San Francisco’s civilian oversight system has traditionally been the police chief. The Office of Citizen Complaints has its problems, and some valid cases get dismissed, but overall, the agency investigates and recommends disciplinary action in most of the serious abuse cases. But the former chief, Heather Fong, repeatedly declined to impose credible discipline, either dismissing or ignoring the OCC’s findings. One single officer, Jesse Serna, has so far cost the city $580,000 in legal settlements stemming from improper conduct — but he’s still on the force.

Yes, the OCC has a huge backlog, and some of the cases the agency presents may be weak. Gascon has proposed dismissing about 75 cases now before the Police Commission — mostly, he says, minor offenses like failing to file a proper police report. But the cases that have gone before the commission typically aren’t minor — offenses that could result in as much as a 10-day suspension are resolved by the chief. The commission gets cases that are more serious — or that the chief refuses to act on.

Before Gascon starts talking amnesty and clearing minor cases, he needs to demonstrate that he’s going to take a hard line on the serious cases. He claims that "a very small group" in the department has a history that’s "irredeemable." Once he’s helped the commission fire those officers — and sent a clear message that abuse won’t be tolerated — he’ll have the credibility to talk about dismissing less-serious cases.

Don’t be afraid of the POA. There are some good, honest, experienced, qualified officers in the management and command ranks — but there are also people who hold powerful positions because of their union and political connections. And frankly, the Police Officers Association has been a major obstacle to reform. The POA doesn’t run the department, shouldn’t get to chose managers, and needs to be informed by the chief that the needs of the current (sometimes abusive) union leadership are not going to drive department policy.

Take a public stand against secrecy. Under Chief Fong, the San Francisco Police Department seemed terrified of sunshine. The media relations department acted as if releasing any information to the media was a terrifying prospect. Officers and detectives were told to avoid talking to reporters. And the cops — who, for reasons we still don’t understand, have the authority to unilaterally decide who qualifies for a police press pass — use the most narrow interpretation and keep bloggers, small publications, and nontraditional media out of the information loop.

Gascon has done the right thing by bringing in outside help and vowing to expand his definition of news media. But given the stifling climate of secrecy in the department, he needs to do more. Directing his staff to cooperate with the press (through a public general order) would be a big step. Announcing that all police reports (unless they involve a confidential source or situation) will be posted on the Web would go even further.

Chief Gascon has the chance to completely turn around a dysfunctional department. But small steps aren’t going to do it.

Too bad legality and morality so frequently messed with that perfect union. Herewith a highly selective, hardly definitive list of the medium’s

resulting greatest freakouts. It excludes the following: really obvious stuff, like 2001: A Space Odyssey (1968) and Reefer Madness (1936); most horrific withdrawal sequences (that’s another article); and scenes in which performers really do appear very high (inevitably, Dennis Hopper).

Case Study: LSD (1969) Your friends at Lockheed Aircraft Corp. crafted this cautionary educational short in which our heroine, already "pretty jacked up on marijuana," drops you-know-what. She then goes downtown for a hot dog. But when she’s about to consume that tasty snack it turns into a troll doll on a bun, begging for mercy because "He had a wife and seven kids at home to support." Then the screaming starts.

The Big Cube (1969) A spoiled stepdaughter and predator playboy attempt to drive wealthy widow Lana Turner insane by serially dosing her. What’s perhaps most amazing about this awesomely awful potboiler is that Turner’s acting is even worse when her character is straight.

Go Ask Alice (1975) There may be no wrong-trip scene freakier than this TV movie’s one in which our teen runaway protagonist and a temporary traveling companion are made to bark like dogs for an older couple — the "winner" getting a new boost, the loser getting "punishment" horribly left to our imaginations.

Blue Sunshine (1976) Never grab the wig off a secret U.S. government LSD experiment veteran whose secret baldness "covers" homicidal psychosis. And if you do, this cult horror classic teaches, stay the hell away from the fireplace.

Desperate Teenage Lovedolls (1984) This DIY punk parody’s all-female band members avenge themselves on their greedy manager by mega-dosing him, resulting in horrific hallucinations of Taco Bell ads and Barbra Streisand Yentl (1983) posters inspire unfortunate delusions of flight.

Sup. Mirkarimi pushes for transparency in mayor’s security detail costs

Supervisor Ross Mirkarimi has introduced legislation that would require elected officials to reimburse the city for security-detail costs while traveling the campaign trail, the Chronicle has reported. Mirkarimi has been trying unsuccessfully for more than a month to get the Mayor’s Office to disclose how much is being spent on security for Mayor Gavin Newsom as he campaigns for governor outside San Francisco. In response, he’s been told that revealing that dollar amount would be a security risk.

The legislation also seeks to shine some light another longstanding transparency problem: Newsom’s public calendar. Mirkarimi’s proposed rule would require the mayor to submit a detailed schedule, describing how much time was spent on each activity listed.

The Guardian has noted the mayor’s tendency to reveal only a bare minimum of information in the official schedule he publicizes, telling journalists and concerned citizens virtually nothing about how the people’s business is being conducted.

Sunshine advocate Kimo Crossman, who has been publicly calling for a meatier mayoral calendar for years, pointed out that there are already open-government rules in place that have been ignored. “When the Guardian found out the Mayor Willie Brown was shredding his calendars, part of the Prop G enhancement to [the city’s Sunshine Ordinance] required keeping a very detailed calendar and preserving all correspondence in the Mayor’s office,” Crossman told us via email. “The [Sunshine Ordinance Task Force] has found that [mayor’s office spokesman] Nathan Ballard and Mayor Newsom have willfully violated these provisions and therefore committed official misconduct.”

“Subsequently,” he added, “no behavior has changed.”

Today is one of those days when it’s easy to daydream and hard to work. From my window, I can see everything in high definition Technicolor. The port of Alameda and the Berkeley hills are etched against a sky of uninterrupted Wedgewood blue. A clean white sailboat cuts a straight line path through the smooth waters of the bay. Sunshine glints off the windshields of cars rolling across the bridge toward Treasure Island. There are precious few days when San Francisco shrugs off its cloak of fog and shows its striking face in stark, detailed relief. That today is one of them makes it easy to think about cutting out of the office early to kick back on the deck with a glass of wine. Not red, no. Let me say emphatically, today is a white wine kind of day.

The Ethics Commission fiasco

EDITORIAL The San Francisco Ethics Commission is a serious mess, and if Director John St. Croix can’t turn things around — quickly — he needs to resign and make room for someone who can.

Ethics has badly damaged its reputation in recent years by hounding small-time violators from grassroots campaigns and ignoring the major players who cheat and game the system as a matter of practice. A couple of festering examples:

In 2004, then-Ethics Director Ginny Vida and Deputy Director Mabel Ng ordered the staff to destroy public records that pointed to malfeasance on the part of the Newsom for Mayor campaign. The records — which the Newsom campaign sent to the commission by mistake — suggested that the newly-elected mayor was illegally diverting money from his inaugural committee to pay off his campaign debt.

St. Croix admits that the agency knew back in 2005 that public money was being laundered and improperly used in a City College bond campaign — but did absolutely nothing. Now, four years later, District Attorney Kamala Harris has indicted three college officials in that case.

In fact, Oliver Luby, an investigator with Ethics, says he brought the problem to St. Croix’s attention back when that bond campaign was still underway — and was told, in essence, to shut up. "He instructed me not to speak of my report," Luby wrote in a Nov. 4, 2008 San Francisco Chronicle opinion piece.

But the well-paid operatives working for City College and Newsom never felt the sting of an Ethics investigation. Instead, the commission spent thousands of dollars hounding Carolyn Knee, the treasurer of a public-power campaign, threatening the volunteer who lives on a modest fixed income with more that $20,000 in fines. (The case wound up being resolved with a fine of $267.)

And now Luby — who was honored for his courage as a whistleblower by the Society of Professional Journalists — has been demoted, received a formal reprimand from Ng (for doing something other staffers have done routinely) and is under investigation on the basis of an anonymous complaint.

Luby’s technical violation: writing a letter from his Ethics e-mail account during work hours commenting on new regulations proposed by the state’s Fair Political Practices Commission. Ng, writing as Luby’s supervisor, claims in a reprimand letter that no employee has the right to speak for the agency, and that someone in Sacramento might have misjudged his personal comments as official Ethics Commission policy. (Nobody has suggested that his comments were anything but useful or that anything he said would damage the city’s reputation. And others in the agency comment on this sort of thing all the time, with no punitive repercussions.)

Now there’s an anonymous complaint against him raising the same issue, suggesting that he was using city resources for his own personal political causes. (Never mind that his job is working on the exact same issues as the FPPC rules cover and that he has absolutely no political or personal stake in the outcome.)

This city desperately needs aggressive enforcement of the political reform laws — and people like Oliver Luby ought to be getting praise and support from management and ought to be put in charge of ferreting out corruption. Instead, St. Croix and Ng are trying to hound him from his job.

The commission members need to tell St. Croix and Eng to drop the complaints against Luby, change the agency’s priorities and start going after the real scofflaws. The Board of Supervisors also needs to convene hearings on the problems at Ethics, something that Sups. David Campos and John Avalos have indicated a willingness to do.

P.S. : Since Ethics has refused to follow-up on the City College mess, the D.A.’s Office needs to pursue the case as broadly as possible, looking not just at the chancellor and his two aides but at anyone else who might have knowledge of the alleged criminal activity. And the Community College Board needs to move immediately to launch a fully public internal investigation and start complying with the city’s Sunshine Ordinance. *

SCENE: Pacific Sound takes it outside

For 15 years, the much-loved and lovable warm-weather Sunset parties have shaken various hills, isles, parks, patios, and boats with funky, techy house sounds. Launched by underground hero DJ Galen in 1994 (has it really been that long?), the outdoor Sunset gigs have amassed a huge following of excited party newbies and familiar old-school faces — and now their kids! Early on in the game, Galen was joined by fellow Bay favorite DJs Solar and J-Bird, and the three — collectively known as Pacific Sound (www.pacificsound.net) — have kept the vibe strong ever since. This year saw a remarkable expansion on the Sunset fan base: attendance at the season opener at Stafford Lake reached almost 4,000, and Pacific Sound just launched an annual — and truly moving — party on Treasure Island that had multiple generations putting their hands in the air. "The vision was to take electronic music out of the dirty warehouses, away from the dodgy promoters, and into the sunshine," says J-Bird. Summer’s just begun, and Pacific Sound, with several gangbuster parties lined up, keeps delivering.

SFBG You guys have been a major part of the party scene here for a while. What do you think of it right now?

Pacific Sound There’s a foundation for creativity in San Francisco — that is something that will never change. Also, there definitely is quite a bit more international talent coming here than 10 years ago. It’s this constant exposure to musical stylings from around the world that will facilitate a thriving scene. The recent crackdowns by the SFPD and ABC may be dampening some spirits, but it will never stop our creative heritage.

SFBG You mean all the pressure on venues lately …

B.B. King charms the Fillmore

When someone is a master of their art, it means they can make the simplest things genius. Think of Alice Waters: she’s one of the most famous chefs in the world and her dishes are based on totally minimal ingredients. B.B. King (http://www.bbking.com/) is the master of blues guitar. On May 21, King played to an ecstatic audience at the Fillmore Theater. King plays like no other musician I’ve ever seen, lingering on the silences, or playing only one exquisite note that lasts for over a minute and sounds like an orchestra of complexity. King is also an incredible storyteller, relating tales about his life as an 83 year old guitarist traveling the world to play music and even about discovering Viagra, with constant accompaniment from his band to gives his stories even more umph. He also has quite an appreciation for all the ladies and had everyone sing “You are my sunshine” followed by a required kiss between any lovers in the audience. The artist made sure the house lights were raised … he just loved watching the ladies get smooched! King is beyond comfortable and charismatic on stage, and with over 15,000 concerts under his belt, I’m sure this master has quite a few more tunes to share with many more audiences around the world.

New art and style on Geary

With a calm demeanor and a pulled-together, no-nonsense appearance, Claudia Altman-Siegel isn’t an obvious suspect when it comes to identifying the driving force behind a conceptual art show that draws well-heeled European tourists and people clad in Converse shoes and skinny jeans. Both types, and more, are drawn to Matt Keegan’s "Postcards & Calendars," where they’re confronted by an eight-foot list of days of the week and a larger-than-life photograph of a New York Times reader hidden behind dismal headlines.

The four month-old Altman Siegel Gallery is set apart from neighboring galleries by its inclusion of a window, a trait that trades art hermeticism for the possibility of sunshine. Street noise is present but not disruptive — a reminder that another world exists beyond the space’s light cocoon of images and ideas. It has a distinctively different aura from the other galleries in the 49 Geary St. building, something Altman-Siegel says she is "sort of blind to."

After 10 years of work in New York City, Altman-Siegel slipped over to San Francisco to fill a gap in the West Coast gallery scene, bringing emerging local and internationally established artists who are still early on the trajectory to significance in the art canon.

Local art or specificity is prominent in Altman-Siegel’s curatorial work to date. The current show, though by a New York artist, includes sketches of familiar San Francisco street corners. Bay Area artist Trevor Paglen’s surreal cosmic photographs were the focus of the gallery’s first solo show.

Across the street, mannequins wearing teal trousers topped by black, multipocketed jackets and craftily reconstructed vintage dresses stand defiantly among an installation of birch tree branches and rusted machinery. A former STA travel office has been transformed into Shotwell, a cutting-edge update of a funky Aunt Edna boutique.

Newlyweds Michael and Holly Weaver needed somewhere to hawk their extensive collection of vintage clothes. When they landed a lease at 36 Geary St., the shop expanded to fuse groundbreaking European fashion and clothes by Bay Area designers. Denim from local menswear line B.Son is paired with chic shirts by Parisian collective Surface2Air. Shape-shifting square dresses from the San Francisco duo Please Dress Up! hang alongside bold separates by British label Scout. On the other side of Silverman Gallery’s recent move to Sutter Street, the openings of Shotwell and Altman-Siegel suggest that something new and bold is creeping up on Union Square.

Making sunshine work

EDITORIAL The Sunshine Ordinance Task Force and the Ethics Commission are talking to each other, which is some small progress on one of the most annoying lingering issues in San Francisco. But the joint meeting last week, while positive in tone, didn’t solve the basic problem.

Under the city’s Sunshine Ordinance, the task force investigates complaints about city agencies improperly withholding records or meeting in secret. If the task force members find that there’s been a violation — and that the matter is serious enough to merit enforcement action against the city officials involved — the file is forwarded to Ethics, which can charge elected and appointed officials with misconduct.

But that never happens.

Fourteen times the task force has asked Ethics for action, and 14 times those cases have been dismissed — with little serious investigation. In fact, at the April 24 meeting, John St. Croix, the executive director of Ethics, admitted that his staff doesn’t always interview the complainants in these cases. Instead, Ethics asks the respondent for his or her side, and relies heavily on the advice of the city attorney.

That’s a problem in itself, because sometimes City Attorney Dennis Herrera will advise a department to keep something secret when the task force — which has its own lawyer, also from the City Attorney’s Office — disagrees. And in some cases it’s very clear that city officials have willfully ignored, defied, or sought to circumvent the open-government law.

Mayor Newsom, for example, refuses to release his full appointments calendar, which would show the public whom he’s meeting with — a key way for San Franciscans to understand who is influencing, and seeking to influence, city policy. The New York Times just published a detailed investigative report on Treasury Secretary Timothy Geithner’s ties to Wall Street financiers, basing the story in significant part on a review of Geithner’s appointment calendars. The New York City Federal Reserve Bank — a secretive institution if ever there was one — released the calendars of Geithner’s appointments when he was bank president. Newsom can certainly do the same, and the law requires him to. But he simply ignores that mandate.

The district attorney also has the authority to enforce the law, but has never filed a single sunshine violation case.

The San Francisco Sunshine Ordinance is supposed to be the best and most comprehensive law in the state ensuring public access to government activities. But it’s rendered almost meaningless when city officials can defy it, routinely, and suffer no consequences.

The current enforcement system is simply not working. The supervisors should hold hearings on this with the goal of placing a charter amendment on the ballot giving the task force the independent authority to order documents released and adopting a more effective way to sanction officials who disregard the law. The task force should also have the right to take cases directly to the Ethics commissioners and prosecute them in public before the full commission. It’s the biggest open government issue in the city right now. Which supe wants to take it on? *

Blocking California’s sunshine: Proposed legislation would limit access to public information

The California Public Records Act guarantees the right to be able to request government documents that are part of the public record. But proposed legislation heard today by the Assembly Judiciary Committee would restrict access in certain cases. The bill, titled AB 520 and introduced by Assemblywoman Wilmer Amina Carter (D-Rialto), would authorize a superior court to limit the scope of requests a member of the public can make if the court determines that the requestor is seeking information for an “improper purpose.” The text of the bill leaves the definition of “improper” open-ended, specifying only that it is “including, but not limited to, the harassment of a public agency or its employees.”

The bill is still in the early stages, but sunshine advocates are watching closely and weighing in. Californians Aware (CalAware), the California Newspaper Publishers Association (CNPA), and the Freedom of Information Committee of the Society of Professional Journalists Northern California Chapter have all come out against it. Letters of opposition pointed out that even without this new restriction in place, government agencies are often slow to release public records. “Every audit performed by Californians Aware, the California First Amendment Coalition, or CNPA member newspapers such as the Contra Costa Times or Stockton Record, has shown abysmal compliance with the law,” CNPA noted in a letter to Assemblywoman Carter.

Others characterized the proposed rule as an erosion of the principles of open government that are embodied in the state constitution. “The ultimate principle arguing against AB 520 is that like the right of speech itself … the right to obtain information found in public records is so fundamental to informed democracy that certain expressions of that right, while they may be deplored as an excess of license, must be tolerated as a cost of liberty,” CalAware’s opposition letter reads.

For a truly life changing experience, get a shot of the drinking chocolate at the Tcho pier outpost. If you don’t have a keen eye, the little retail space, adjacent to the factory where the delicate fair-traded chocolate is made, is easy to miss. But the powerful, decadent drinking chocolate is so buoyant with flavor — notes of citrus and nut — that it’s impossible to forget. In fact, I almost couldn’t stand to swallow it. I wanted that silky chocolate in my mouth forever.

MARA’S


If I had an Italian grandmother, I imagine that her kitchen would be something like Mara’s, where the windows overflow with cookies and croissants and fading posters of the motherland covered the walls. Good thing I can slide up to North Beach to enjoy Mara’s cannoli as a grandma substitute.

A big smile (and maybe a wink) will get you a sample from one of the glass jars filled with goodies that line the walls of the Candy Store in Russian Hill. Just be careful — this is a child’s dream world and snatching a cantaloupe-sized rainbow lollipop out of the hands of a wide-eyed tyke won’t go over so well with the shop girl.

SCHUBERT’S BAKERY


The long glass case that runs the length of Schubert’s Bakery in the Richmond District displays the most delectable selection of cakes I’ve ever seen. The bakery has been a city institution for almost a century, and I have no doubt it’s because life is incomplete without their currant mousse and classic cheesecake.

For French treats in an English garden-inspired atmosphere, the madeleines at Miette can’t be beat. The tiny fluffy, moist, shell-shaped cakes are delightful when paired with cappuccinos or tea, and may induce a Proustian awakening after a long, tiring day.

COCOLUXE


Truffles are a standard luxury, one not often married to sleek and slightly cheeky design. Best enjoyed while kicking back in one of the white retro chairs in the mod space.

EGGETTES


When willing to go further afield — both in culinary palate and location — the cream-filled, egg-shaped waffles at Eggettes are worth the adventure. Hong Kongers eat eggettes, a popular street food served in paper bags punched with holes, for breakfast. I can’t handle the pastel-drowned Easter-egg interior of the Sunset District shop before 10 a.m., but certainly enjoy the warm puffs as an afternoon snack.

I’m not a huge Seth Rogen fan. He’s charming enough, I guess, and I always have a soft spot for Jewish actors who aren’t conventionally attractive (Jason Schwartzman and Woody Allen, I’m talking to you). But since I am neither a 17-year-old boy nor a stoner, Rogen’s comedies simply don’t do much for me; hence, neither does he.

However, I’ve developed a new affection for him after stumbling across a video of him performing stand-up as a teenager on one of my favorite time suck sites, www.idontlikeyouinthatway.com. In the video, he’s surprisingly confident and funny for his age. Plus, he’s taking shots at Judaism — a sure way to warm this semi-Semite’s heart.

I’m still not going to see Observe and Report, or probably ever finish more than 20 minutes of Knocked Up. But when he gets a little older and starts doing more comedian-turned-serious-actor stints (a la Jim Carrey in Eternal Sunshine of the Spotless Mind), I might actually buy a ticket to see him rather than watching his film for free via www.sidereel.com. Nice job, 13-year-old Seth. You’ve (almost) caught yourself a nice (almost) Jewish girl. At least, as a possible fan.

California’s a tough place. It’s a state of clashing values — of coastal liberals who want good public services, environmental protection, and gay marriage and central valley conservatives who want nothing of the sort. It’s run by a fractious, divisive legislature that desperately needs a firm hand. It’s a state so big and complex that it has defied the abilities of generations of talented politicians, from Jerry Brown and George Deukmejian to Gray Davis and Arnold Schwarzenegger.

And yet, we refuse to give up on the Golden State. It’s been the Guardian‘s home since 1966, the place where we launched what would be the first alternative paper on the West Coast. It’s a place with endless possibilities, from sunshine to public power to tax reform, and we can’t risk its future on another worthless, wimpy chief executive.

That’s why we’re taking the unusual step of announcing an early endorsement for governor. We’re backing the only candidate strong enough, smart enough, sober enough, and secure enough in his own self worth and image to take on the Sisyphean task of running California. Today, we’re endorsing Gavin Newsom.

The mayor of San Francisco may look like a lightweight fop, but that’s unfair — we know him better. This is a young man who grew up cleaning toilets then went on to found his own successful business, using nothing but the wealth and connections of a billionaire family friend to help him. A man who has never spent a day in his life without comfortable surroundings yet developed a remarkable empathy for the less fortunate, and capitalized on their misery to promote his career. A man who travels the world in the company of movies stars and brilliant entrepreneurs, fearlessly promoting his home town while the rest of the whiney little twerps at City Hall just sit in committee meetings and bitch.

Losers.

Newsom’s platform is perfect for this state, at this time. He supports marriage; after all, he’s done it twice himself. He’s even gotten involved in the marriages of close friends and advisors! And he thinks the rest of us, no matter what our sexual proclivities, should have the right to be miserable too.

Newsom talks not just of change, but of "gigantic order-of-magnitude change." He thinks we should all come together to solve the state’s problems instead of pointing fingers of blame — and isn’t that just the sweetest?
