Is SF’s DA investigating Rose Pak?

Well, Ms. Pak thinks he is. At the Chinese New Year parade, where she wields the mic at the reviewing stand and typically makes nasty comments about local politicians, she was relatively muted this year –– except when D.A. George Gascon rode by. “I read in the blogs that you’re still investigating me,” she shouted. “What the hell did I do? I just elected the first Chinese American mayor. You will find nothing, except that I swear a lot.”

Gascon has for more than four months been investigating irregularities in the Ed Lee campaign, including charges of illegal campaign contributions and voter fraud. Gascon’s office issued a press release Feb. 14 announcing the indictments of Go Lorries and two of its senior employees. The airport shuttle outfit allegedly laundered campaign money by asking its employees each to donate the maxium $500 to Lee’s campaign and then paying them back from company funds. From the release:

The defendants are accused of making an unlawful $11,500 campaign contribution from GO Lorrie’s to the Ed Lee campaign by passing it through GO Lorrie’s drivers and staff. … “Campaign finance and disclosure laws help to ensure fairness and transparency in our elections,” said District Attorney George Gascón, “and my office takes the violation of these laws very seriously.  After a thorough investigation, we have found clear evidence to charge Go Lorrie’s and two of its employees with making illegal campaign contributions.”

Nobody from the Lee campaign has been charged with anything.

So what about the other apparent violations? Is that still under investigation? Is Rose Pak a target? I asked Stephanie Ong Stillman, Gascon’s spokesperson, and she told me that she can’t confirm or deny that there’s any further investigations under way or that any specific individual is under investigation.

So I’m glad to see the Go Lorries indictment, which marks a rare instance of somebody taking campaign laws seriously. But there’s a lot more here, and I hope Gascon doesn’t think that nailing one company that everyone will insist acted on its own with no support from or connection to a pretty darn sleazy campaign will end the controversy.

 

 

Would Sept. elections be better than RCV?

A proposal by Supervisors Sean Elsbernd and Mark Farrell to end San Francisco’s experiment with Ranked Choice Voting will come before the board Feb. 14, and RCV suporters are organizing to fight it. According to an email I just got from Steve Hill, one of the leaders in the RCV movement, “the vote is going to be close.”

The first version of the Elsbernd-Farrell legislation would have returned the city to the pre-RCV situation — the general election for city offices would take place in November, and runoffs in any race where nobody got a majority (almost every contested city race these days) would take place in December. 

The December turnout in Board of Supervisors races was always way lower that the turnout in the November election (although that hasn’t always been the case in mayoral races — more people voted in the Matt Gonzalez-Gavin Newsom runoff than voted in that year’s general election).

But the two conservative supervisors have backed off that plan and replaced it with another one: The first election (in effect, the primary) would be held in September, with the runoff in November.

Some years, that would be three elections in the city in five months — the normal June state election, a September city election, and a November general election.

I realize that a lot of people, including some of my friends on the left, aren’t thrilled with RCV. If the mayor’s race had a runoff, it would have been a head-to-head contest between Ed Lee and Dennis Herrera, and that would have been fun. (Where would David Chiu, who got stabbed in the back by Lee and who criticized him during the general election, have gone in the runoff? What about Leland Yee?)

But I have to say, a September election seems like a really terrible idea. When are the candidates going to campaign — during August, when about half of the city is out of town? Would the candidates all have to trek out to Burning Man? (You can’t send direct mail flyers to the playa.) Maybe you hold the election late in September — but then the absentee ballots would arrive when, over Labor Day weekend? Talk about low turnout.

The whole idea of RCV was to get more people involved in electing their representatives at City Hall. You can talk about whether it helps the left or the right or incumbents or whatever, but it’s really all about turnout. One election: More people vote. Two elections: Fewer people vote. September election: Very few people vote.

Then in November, when the turnout is highest, the choice will be lowest, because the candidates who did well in the low-turnout election (typically the more conservative candidates) will be the only ones on the ballot.

On balance, I’m sticking with RCV — but if you have to change it, why not make the primary election in June? There’s already a June election in even-numbered years, it’s no added expense — and there’s the additional value of forcing candidates for mayor and supervisor to declare their intentions and get in the race early on. No more Ed Lee August surprise.

I asked Elsbernd about it and he told me that New York City holds its primary in September, and that’s an effective model. And, he pointed out, there’s no June primary in the odd-numbered years, when the mayor, sheriff, city attorney, treasurer and public defender are on the ballot.

True — but if you’re going to have a special municipal election anyway, June makes more sense to me. People are used to voting in June. I worry about September.

Federal government sets its sights on 12 more SF dispensaries

Bad news for medical marijuana patients in the Bay Area: as reported by the SF Examiner, the DEA has requested records from the city’s Department of Public Health for 12 of San Francisco’s existing 21 cannabis dispensaries. This is the same move the DEA made before sending the threatening letters to five other cannabis collectives last fall. Those five dispensaries are now closed.

In fall of 2010, US Attorney Melinda Haag targeted five SF dispensaries in school zones with letters declaring them in violation of federal law. In the face of potential jail time for dispensary staff and even the landlords of the buildings that housed the dispensaries, they shut their doors. Now, more than 50 percent of the city’s dispensaries could have to follow suit. 

The really upsetting part about all of this? The sheer randomness of it all. In our recent Cannabis Issue, the Guardian interviewed Assemblymember Tom Ammiano, who said that in his meeting with Haag over the matter, the US Attorney said the orders to persue the dispensaries came from above. “She said she was only doing what the boss was telling her to do,” Ammiano told the Guardian. “We had a hard time with that.” The Obama Administration has been frustratingly opaque about the motives behind, and future plans for, persecuting an industry that Attorney General Eric Holder once called a “low priority” for federal law enforcement. 

The Guardian has sent an email to Mayor Ed Lee for his comments on the request for records, and will update this post when we hear back. Even then-Mayor Gavin Newsom, as the Examiner pointed out, sent a letter in 2008 to Congress to encourage it to act against the DEA’s attempts to intervene in California’s medical marijuana industry.

Assemblymember Ammiano and Senator Mark Leno are leading the efforts to establish a statewide regulatory board cannabis that would, among other things, demonstrate to the feds that the industry is being well-regulated in California. Americans for Safe Access and UFCW (the union representing cannabis workers in California) have also introduced a ballot initiative called the Medical Marijuana Regulation, Control, and Taxation Act that would establish a regulating board made of patients, government representatives, medical professionals, and cannabis industry folks. A poll conducted by Probolsky Research recently put voter support for that measure at 59.2 percent.  

But who knows if California voters will get a chance to regulate marijuana as they see fit. If these requests for records proceed as the last round of them did, SF could be down to nine dispensaries in a city with not only a large base of cannabis patients, but also a thriving cannabis culture.

Christina Olague, the newest member of the Board of Supervisors, faces a difficult balancing act. She was appointed by Mayor Ed Lee, whom she supported as co-chair of the controversial “Run Ed Run” campaign, to fill the vacancy in District 5, an ultra-progressive district whose voters rejected Lee in favor of John Avalos by a 2-1 margin.

So now Olague faces the challenge of keeping her district happy while staying on good terms with the Mayor’s Office, all while running in her first campaign for elected office against what could be a large field of challengers scrutinizing her every vote and statement.

Olague has strong progressive activist credentials, from working with the Mission Anti-Displacement Coalition to protect low-income renters during the last dot-com boom to her more recent community organizing for the Senior Action Network. She co-chaired the 2003 campaign that established the city’s minimum wage and has been actively involved in such progressive organizations as the Milk Club, Transit Riders Union, and the short-lived San Francisco People’s Organization.

“One of the reasons many of us are so supportive of Christina is she is grounded in the issues of low-income San Franciscans,” said Gabriel Haaland, who works with SEIU Local 1021 and accompanied Olague to a recent interview at the Guardian office.

She also served two terms on the Planning Commission — appointed by Board of Supervisors then-President Matt Gonzalez in 2004 and reappointed by then-President Aaron Peskin in 2008 — where she was known for doing her homework on complicated land use issues and usually landing on the progressive side of divided votes.

“Coming from the Planning Commission, she can do a lot of good,” said Tom Radulovich, executive director of Livable City and a supporter who has worked with Olague for 15 years. “We lost a lot of collective memory on land use issues,” he said, citing the expertise of Chris Daly and Aaron Peskin. “We do need that on the board. There is so much at stake in land use.”

Olague disappointed many progressives by co-chairing Progress for All, which was created by Chinatown power broker Rose Pak to push the deceptive “Run Ed Run” campaign that was widely criticized for its secrecy and other ethical violations. At the time, Olague told us she appreciated how Lee was willing to consider community input and she thought it was important for progressives to support him to maintain that open door policy.

In announcing his appointment of Olague, Lee said, “This is not about counting votes, it’s about what’s best for San Francisco and her district.” Olague also sounded that post-partisan theme, telling the crowd at her swearing-in, “I think this is an incredible time for our city and a time when we are coming together and moving past old political pigeonholes.”

With some big projects coming to the board and the working class being rapidly driven out of the city, progressives are hoping Olague will be a committed ally. There’s some concern, though, about her connections to Progress For All campaign’s secretive political consultant, Enrique Pearce.

Pearce has become a bit of a pariah in progressive circles for his shady campaign tactics on behalf of powerful players. In 2010, his Left Coast Communications got caught running an independent expenditure campaign partly funded by Willie Brown out of Pearce’s office, even though Sup. Jane Kim was both its beneficiary and his client — and that level of coordination is illegal. Last year, Pearce was hired by Pak to create the “Run Ed Run” campaign and write the hagiographic book, The Ed Lee Story, which also seemed to have some connections with Lee’s campaign. The Ethics Commission hasn’t fined Pearce for either incident, and he didn’t return a Guardian call for comment.

Olague told us not to worry. “He’s a friend…and I think it’s an exaggerated concern,” she said, confirming but minimizing his role so far. Yet she hired one of Pearce’s former employees, Jen Low, as one of her board aide. Olague’s other aides are Chris Durazo from South of Market Community Action Network (SOMCAN) and Dominica Henderson, formerly of the SF Housing Authority.

Debra Walker, a progressive activist who served on the Building Inspection Commission and has worked with Olague for decades, said she’s a reliable ally: “She’s from the progressive community and I have no equivocation about that.”

Olague makes no apologies for her alliances, saying that she is both independent and progressive and that she should be judged by her actions as a supervisor. “People will have to decide who I am based on how I vote,” she said, later adding, “I support the mayor and I’m not going to apologize for that.”

 

OLAGUE’S PRIORITIES

Olague was born in Merced in 1961 to a Mexican immigrant father who fixed farming equipment and a stay-at-home mother. She went to high school in Fresno and moved to the Bay Area in 1982. She attended San Francisco State University but had to drop out to help support her family, working at various stock brokerage firms in the Financial District. She later got a degree in liberal studies from California Institute of Integral Studies.

In 1992, Olague’s mother was in serious car accident that left her a quadriplegic, so Olague spent the next seven years caring for her. After her mother died, Olague left the financial services industry and became a community organizer for the Mission Anti-Displacement Coalition, battling the forces of gentrification and then-Mayor Brown and becoming an active player in the ascendant progressive movement.

But Olague never abided progressive orthodoxy. She backed Mark Leno over the more progressive Harry Britt in their 2002 Assembly race and backed Leno again in 2007 when he ran for state Senate against Carole Migden. She also voted for the Home Depot project on Bayshore Boulevard despite a progressive campaign against the project.

Olague worked with then-Sup. Chris Daly to win more community benefits and other concessions from developers of the Trinity Plaza and Rincon Tower projects, but now she is critical of Daly’s confrontational tactics. “Daly’s style isn’t what I agree with anymore,” Olague said, criticizing the deals that were cut on those projects to approve them with larger than required community benefits packages. “I think we romanticized what we got.”

So how does Olague plan to approach big development proposals, and is she willing to practice the brinksmanship that many progressives believe is necessary to win concessions? While she says her approach will be more conciliatory than Daly’s, she says the answer is still yes. “You push back, you make demands, and if you don’t think it’s going to benefit the city holistically, you just fucking say no,” Olague said.

Walker said Olague has proven she can stand up to pressure. “I think she’ll do as well as she did on the Planning Commission. She served as president and there is an enormous amount of pressure that is applied behind the scenes,” Walker said. “She’s already stood up to mayoral pressure on some issues.”

Yet even some of Olague’s strongest supporters say her dual — and perhaps dueling — loyalties to the Mayor’s Office and her progressive district are likely to be tested this year.

“It’ll be challenging for her to navigate,” Radulovich said. “The Mayor’s Office is going to say I want you to do X and Y, and it won’t always be progressive stuff, so it’ll be interesting to see how that plays out.”

But he said Olague’s land use expertise and progressive background will likely count for more than any bitter pills that she’s asked to swallow. “Sometimes, as a policy maker, you have to push the envelope and say we can get more,” he said. “It helps if you’re willing to say no to things and set boundaries.”

When we asked Olague to lay out her philosophy on dealing with land-use issues, she said that her approach will vary: “I have a very gray approach, project by project and neighborhood by neighborhood.”

Only a couple weeks into her new role, Olague said that she’s still getting a lay of the land: “I’m in information gathering mode, meeting with neighborhood groups to try to figure out what their issues are.”

But Olague said she understands that part of her job is making decisions that will disappoint some groups. For example, after Mayor Lee pledged to install bike lanes on Fell and Oak streets to connect the Panhandle to The Wiggle and lessen the danger to bicyclists, he recently stalled the project after motorists opposed the idea.

“I’m a transit-first person, for sure. I don’t even drive,” Olague said of her approach to that issue, which she has now begun to work on. “We’ll try to craft a solution, but then at some point you have to fall on one side or the other.”

 

THE “JOBS” FOCUS

One issue on which Olague’s core loyalities are likely to be tested is on the so-called “jobs” issue, which both Lee and Olague call their top priority. “Jobs and economic revitalization are very important,” she told us.

Progressives have begun to push back on Lee for valuing private sector job creation over all other priorities, such as workers’ rights, environmental safeguards, and public services. That came to a head on Jan. 26 at the Rules Committee hearing on Lee’s proposed charter amendment to delay legislation that might cost private sector jobs and require extra hearings before the Small Business Commission. Progressives and labor leaders slammed the proposal as unfair, divisive, unnecessary, and reminiscent of right-wing political tactics.

But when we interviewed Olague the next day, she was reluctant to criticize the measure on the record, even though it seemed so dead-on-arrival at the Board of Supervisors that Mayor Lee voluntarily withdrew it the next week.

Olague told us job creation is important, but she said it can’t squeeze out other priorities, such as protecting affordable rental housing.

“We always have to look at how the community will benefit from things. So if we want to incentivize for businesses, how do we also make it work for neighborhoods and for people so that we don’t end up with where we were in the Mission District in the ’90s?” she said.

Olague also said that she didn’t share Lee’s focus on jobs in the technology sector. “There’s a lot of talk of technology, and that’s fine and I’m not against that, and we can see how it works in the city. But at the same time, I’m concerned about folks who aren’t interested necessarily in working in technology. We need other types of jobs, so I think we shouldn’t let go of the small scale manufacturing idea.”

WTF, Debra Saunders?

I really, really can’t figure out what the Chron’s only local editorial page columnist, the conservative Debra Saunders, is trying to say. If I read her Feb. 8 column right, she’s opposing the Appeals Court ruling on same-sex marriage — and she seems to be saying that Mayor Gavin Newsom was wrong to allow gay marriages and that the whole matter ought to be decided by a statewide vote:

When the California Supreme Court ruled in favor of same-sex marriage, Newsom stood on the steps of City Hall crowing, “It’s going to happen – whether you like it or not.” Newsom didn’t bother trying to win Californians over to his cause. He figured the courts would impose same-sex marriage on them. And then voters don’t have to like it.

Again — I don’t get it. By the tone of her column, you could almost get the impression that she’s against same-sex marriage. At the very least, she doesn’t seem to fathom that some basic civil and human rights aren’t and never have been subject to the will of the voters. If you asked the voters in Topeka, Kansas in 1954 whether the local schools should be forcibly desegregated, I think it’s a good bet that segregation and racism would have won at the ballot box. Is she trying to argue against Brown v. Board of Education?

I wrote her an email and asked her to explain — really, Debra, I want to understand, but I’m baffled — and I gave her all day to get back to me, but I haven’t heard.

 

 

Local control of cops

Sup. Jane Kim has introduced legislation to the Board of Supervisors calling for a re-examination of the San Francisco Police Department’s participation in some aspects of the Joint Terrorism Task Force, which was created by the Federal Bureau of Investigations to do domestic surveillance.

The proposed ordinance would prohibit the SFPD from working with the JTTF to collect intelligence on individuals in the absence of criminal wrongdoing, which has been a concern of civil libertarians since last year when a secret memo revealed that local officers were under FBI command and not bound by local and state restrictions on such surveillance (see “Spies in blue,” 4/26/11).

Kim said the ordinance was necessary to ensure the “requirement of reasonable suspicion before we do any type of investigation of criminal activity. And we don’t base it on ethnic identification or religious practice as some of the members of the community have been experiencing the last couple of years.

“Our office is sponsoring this because many members of the Arab, Asian and the Muslim community worship in the district and own many small businesses,” she said.

Critics of the relationship between local and federal law enforcement agencies, facilitated through participation in the JTTF, have long raised concerns about racial profiling and unnecessary spying ordered at the federal level, and carried out by SFPD inspectors assigned full time to the task force.

Federal regulations governing FBI intelligence gathering are weaker than standards set by San Francisco and California’s Constitution. In 1990, the San Francisco Police Commission established rules requiring that intelligence-gathering involving any First Amendment activity be based on reasonable suspicion of significant criminal activity. Those rules reflect the California Constitutional requirement of an “articulable criminal predicate” before law enforcement agencies engage in intelligence-gathering activity.

However, because the SFPD inspectors assigned to the JTTF work under the direction of the FBI, the local regulation and control of law enforcement is effectively limited in JTTF investigations.

“It’s important that a clear prohibition against policing based on race, ethnicity, national origin, or religion applies to all of our officers, all of the time,” said John Crew, police practices expert for the Northern California chapter of the American Civil Liberties Union. The ACLU is one of more than 30 civil rights and community organizations participating in the Coalition for Safe SF, which helped develop the proposed ordinance.

According to the coalition, current rules prevent the SFPD from barring its inspectors assigned to the JTTF from joining FBI agents in collecting intelligence on San Franciscans without any “particular factual predication.”

“The purpose of this legislation is to restore local control, civilian oversight, and transparency over the SFPD’s participation in FBI intelligence-gathering,” stated attorney Nasrina Bargzie of the Asian Law Caucus, which is part of the coalition.

The coalition was a major participant in the San Francisco Human Rights Commission hearing in 2010 on the issue of baseless spying and racial profiling in JTTF investigations. The result was a comprehensive report, endorsed by the Board of Supervisors last spring.

But in 2011, the ACLU and Asian Law Caucus learned that key protections for civil liberties — including civilian oversight of intelligence activity and safeguards to limit intrusive tactics — were thrown out the window and replaced by a secret Memorandum of Understanding with federal law enforcement in 2007.

Under the MOU, SFPD paid officers work out of the local FBI office. The secure nature of their work means they must seek federal permission to even talk to their superiors in the SFPD about their work, effectively removing them from the local chain of command. Despite mandated requirements on local law enforcement, the MOU does not allow for any civilian oversight of the work of officers assigned to the JTTF.

San Francisco Chief of Police Greg Suhr said he believes that the concerns have already been addressed. In his first days in office, Chief Suhr issued a binding Bureau Order #2011-07 setting forth the requirement that officers comply with local standards.

An excerpt of the order reads, “SFPD officers shall work with the JTTF only on investigations of suspected terrorism that have a criminal nexus. In situations where the statutory law of California is more restrictive of law enforcement than comparable federal law, the investigative methods employed by SFPD officers working on JTTF investigations shall conform to the requirements of such California statutes.”

“With this Bureau Order, the language of the 2007 Memorandum of Understanding no longer applies and SFPD personnel are bound by the provisions of the 2011 Order,” SFPD Public Information Officer Albie Esparza told the Guardian.

But Crew said that as long as the MOU between the SFPD and federal law enforcement remains in place, Suhr’s order at best creates contradictory policy. “The Memorandum of Understanding is a binding legal contact with the federal government. Which do you think will take legal precedence when it comes up against a local police chief’s departmental order?” said Crew, who urged the department to clarify the matter by withdrawing from the MOU, a step the SFPD has thus far been unwilling to take.

A letter from Sept. 28 of last year to Coalition for Safe SF from FBI Special Agent Stephanie Douglas regarding the contradiction clarifies the matter. “I do retain the right to assign FBI JTTF cases,” states Douglas, who goes on to assert it is she who makes the confidential judgment of which cases fall afoul of the state and city rules and which do not.

After years of intelligence-gathering authorized under a secret memorandum, public mistrust in the SFPD’s relationship to federal law enforcement persists. Kim says she believes the proposed ordinance will still help make San Francisco safer. “It increases the trust of the community members that are working with public safety in reporting, and in cooperating around many of the actual criminal activities that might be going on in the city,” she said.

The proposed legislative approach of regulating the scope of local participation in federal JTTF work is not unprecedented. The city has the option of terminating the MOU with 30 days notice, a step that the city of Portland, Oregon has taken to prevent its police force from spying on citizens in violation of local and state law.

In December, the city of Berkeley suspended its agreement with the Northern California Regional Intelligence Center (an arm of the Joint Terrorism Task Force) as part of a broad review of that city’s relationship to other local and federal law enforcement agencies (see “Policing the police,” 12/13/11).

“What this is about is maintaining local control of law enforcement and ensuring the civil liberties of the people of San Francisco,” Crew said. “Don’t San Franciscans deserve the same protection of their civil liberties as the people of Portland?”

Kim was joined by Sups. David Compos and John Avalos in sponsoring the ordinance. Supervisors are expected to vote on the whether to adopt the ordinance this spring after the measure is heard by the city’s Public Safety Committee following the normal 30-day hold. The measure seems to have the support it needs to pass the Board of Supervisors, but it remains unclear whether Mayor Ed Lee, who did not answer our inquiries, will sign it.

Lloyd Suh’s American Hwangap is still one of Magic’s strongest premieres in recent years, an intriguingly funny and affecting cross-cultural tale of an absent Korean father’s return to the family he abandoned in West Texas 15 years earlier. Suh’s latest makes a disappointing contrast. There’s again an absent father (or two) and a sense of dislocation, but Suh’s “Jesus in India” does little or nothing with them. Director Daniella Topol assembles a bright cast headed by musically adept charmer Damon Daunno — on Michael Locher’s colorful, all-encompassing street mosaic set (comprised of floor-to-wall stickers, spray-paint, and mandalas around a central thicket of abandoned bicycle wheels) — but it all serves an insipid chronicle of the deity’s wayward teen years, which are spent getting high and playing in a punk band in India. Pure irreverence might have been worthwhile, but the “dude, fuckin’ &ldots; dude” humor here — one-note and rarely that funny — comes yoked to a fourth-quarter theme (basically a Henry IV thing, the sowing of wild oats ahead of the taking on of a “king’s” responsibilities) that proves even sketchier, not to mention out-of-step with these deliberately leaderless times. Marga Gomez is back at the Marsh, a couple of too-brief decades after inaugurating the theater’s new stage with her first solo show — an apt setting, in other words, for the writer-performer’s latest monologue, a reflection on the inevitable process of aging for a Latina lesbian comedian and artist who still hangs at Starbucks and can’t be trusted with the details of her own Wikipedia entry. If the thought of someone as perennially irreverent, insouciant, and appealingly immature as Gomez makes you depressed, the show is, strangely enough, the best antidote. (Avila)

The first installment of Boxcar Theatre’s four-play Sam Shepard repertory project, True West ushers in the ambitious run with a bang. This tale of two brothers who gradually assume the role of the other is one of Shepard’s most enduring plays, rich with humorous interludes, veering sharply into dangerous terrain at the drop of a toaster. In time-honored, True West tradition, the lead roles of Austin, the unassuming younger brother, and Lee, his violent older sibling, are being alternated between Nick A. Olivero and Brian Trybom, and in a new twist, the role of the mother is being played by two different actresses as well (Adrienne Krug and Katya Rivera). The evening I saw it, Olivero was playing Austin, a writer banging away at his first screenplay, and Trybom was Lee, a troubled, alcoholic drifter who usurps his brother’s Hollywood shot, and trashes their mother’s home while trying to honor his as yet unwritten “contract”. The chemistry between the two actors was a perfect blend of menace and fraternity, and the extreme wreckage they make of both the set (designed by both actors), and their ever-tenuous relationship, was truly inspired. *Vice Palace: The Last Cockettes Musical Thrillpeddlers’ Hypnodrome, 575 10th St, SF; (415) 377-4202, www.thrillpeddlers.com. $30-35. Fri-Sat, 8pm. Through March 3. Hot on the high heels of a 22-month run of Pearls Over Shanghai, the Thrillpeddlers are continuing their Theatre of the Ridiculous revival with a tits-up, balls-out production of the Cockettes’ last musical, Vice Palace. Loosely based on the terrifyingly grim “Masque of the Red Death” by Edgar Allan Poe, part of the thrill of Palace is the way that it weds the campy drag-glamour of Pearls Over Shanghai with the Thrillpeddlers’ signature Grand Guignol aesthetic. From an opening number set on a plague-stricken street (“There’s Blood on Your Face”) to a charming little cabaret about Caligula, staged with live assassinations, an undercurrent of darkness runs like blood beneath the shameless slapstick of the thinly-plotted revue. As plague-obsessed hostess Divina (Leigh Crow) and her right-hand “gal” Bella (Eric Tyson Wertz) try to distract a group of stir-crazy socialites from the dangers outside the villa walls, the entertainments range from silly to salacious: a suggestively-sung song about camel’s humps, the wistful ballad “Just a Lonely Little Turd,” a truly unexpected Rite of Spring-style dance number entitled “Flesh Ballet.” Sumptuously costumed by Kara Emry, cleverly lit by Nicholas Torre, accompanied by songwriter/lyricist (and original Cockette) Scrumbly Koldewyn, and anchored by a core of Thrillpeddler regulars, Palace is one nice vice. *Vigilance Phoenix Theatre, 414 Mason, SF; (415) 335-6087, secondwind.8m.com. $20-25. Thurs-Sat, 8pm; Sun, 2pm. Through Feb 25. Ian Walker (The Tender King) directs a sharp revival of his own lucid, involving 2000 domestic drama about three households brought to the brink by the arrival of a menacing working-class loner. Seamlessly staged in a single pair of rooms (designed by Fred Sharkey) representing all three suburban middle-class homes — as well as downstage on the street where dream-home lottery winner Duncan (an imposing Steven Westdahl) throws his beer cans and leers at the wives and children — Vigilance begins with three friends meeting under the pretext of a poker game. Host Virgil (played with gruff charm by a commanding Mike Newman) is a 30-something husband, father, and guy’s guy whose Montana-grown libertarian machismo compensates for the agro of a stormy marriage and rocky finances. He talks the suggestible, nebbishy Bert (a slyly humorous Ben Ortega) and the equally nerdy but independent-minded Dick (a nicely layered Stephen Muterspaugh) into forming a “committee” to deal with the troublesome Duncan. Walker’s well-honed dialogue brings out the false notes in the supposed pre-Duncan harmony right away, especially in the volatile arguments between Virgil and wife Marla (a sure Natalie Palan Walker) and the passive but more troubled confrontations between Dick and his distant, frustrated wife Cathy (a subtly fraught Kim Stephenson). While the insular, repressed lives of the moderately well off come across well, Duncan’s final monologue is a compressed, if dramatically necessary, attempt at voicing the other side. Vigilance strikes best at the buried politics of marriage and friendship, the latter further invoked in the concerned intervention of cop and childhood friend Frank (a sympathetic Leon Goertzen). (Avila)

The fuchsia papier-mâché tree and swirling grey-on-white floor pattern (courtesy of scenic designer Richard Colman) lend a psychedelic accent to the famously barren landscape inhabited by Vladimir (Keith Burkland) and Estragon (Jack Halton) in this production of the Samuel Beckett play by newcomers Tides Theatre. Director (and Tides’ producing artistic director) Jennifer Welch layers the avant-garde classic with some audio accents as well (although Jon Bernson’s minimalist industrial soundscape is a bit low in the mix to be very effective). More compelling is the gentle, sad humor and couched intelligence captured expertly by Halton in the circular but deliberate rhythms of his hapless tramp. Burkland as pal Vladimir exudes a palpable presence as well, though lacks the same focus. Timing is all in vaudeville — the parallel universe from whence these tangible modernist archetypes hail — as well as in a play whose plot goes intentionally nowhere, or rather loops back on itself in an implied dance with eternity. The halting aspect to Tides’ staging gets compounded with the arrival of brash whip-cracker Pozzo (a suitably stentorian but inconsistent Duane Lawrence) and his pitiful slave Lucky (a haunted, generally sharp Renzo Ampuero, made up to look like a goth doll à la some Tim Burton movie). That said, the best moments here broadcast the brooding beauty of the play, with its purposely vague but readily familiar world of viciousness, servility, trauma, want, fear, grudging compassion, and the daring, fragile humor that can look it all squarely in the eye. This new autobiographical solo show by Don Reed, writer-performer of the fine and long-running East 14th, is another slice of the artist’s journey from 1970s Oakland ghetto to comedy-circuit respectability — here via a partial debate-scholarship to UCLA. The titular Los Angeles residency hotel was where Reed lived and worked for a time in the 1980s while attending university. It’s also a rich mine of memory and material for this physically protean and charismatic comic actor, who sails through two acts of often hilarious, sometimes touching vignettes loosely structured around his time on the hotel’s young wait staff, which catered to the needs of elderly patrons who might need conversation as much as breakfast. On opening night, the episodic narrative seemed to pass through several endings before settling on one whose tidy moral was delivered with too heavy a hand, but if the piece runs a little long, it’s only the last 20 minutes that noticeably meanders. And even with some awkward bumps along the way, it’s never a dull thing watching Reed work. (Avila)

San Francisco celebrates same-sex marriage ruling

While the usual procession of heterosexual couples beamed as they said their wedding vows on City Hall’s Grand Staircase this morning, a historic celebration took place in the South Light Court: hundreds applauded the announcement that same-sex couples are a big step closer to achieving equality in the basic right to marry.

The Ninth Circuit Court of Appeals held today that Proposition 8, which eliminated same sex marriage rights for couples in California, violates the Equal Protection Clause of the U.S. Constitution.

The court ruled that Prop. 8 served no purpose but to discriminate against one class of people, and the Constitution does not allow for “laws of this sort.”

The ruling specifically addressed the arguments advanced by proponents of Prop 8 that gay marriage would interfere with childrearing and religious freedom in the state.

“All parties agree that Proposition 8 had one effect only. It stripped same-sex couples…of the right to obtain and use the designation ‘marriage’ to describe their relationships. Nothing more, nothing less,” the judges wrote.

The ruling does not mean that marriage licenses will immediately be issued to same sex couples. A stay on the ruling has not been lifted. But the stay could be lifted in as early as 21 days from now. But more probably, it will take months or even years; the case is likely to go to the U.S. Supreme Court.

Chief Deputy City Attorney Terry Stewart – the lead attorney that defended San Francisco’s 2004 decision to issue marriage licenses to same-sex couples, which later triggered the Prop. 8 campaign – said the city is eager to see marriage equality, and that “city mechanisms and machinery stand ready to do whatever we can to expedite the process.”

The decision was based partly on logic that, since LGBTQ Californians already have parental rights and the right to domestic partnerships, denying them the right to marry could not be rationalized. City Attorney Dennis Herrera said that this is a “narrow decision,” meaning that if the Supreme Court upholds the ruling, it would apply only to California.

There remains a possibility that the Supreme Court will reject the case, and in that situation the Ninth Circuit decision striking down Prop. 8 would take immediate affect.

Members of the Bay Area coalition of Welcoming Congregations were present at the announcement.

“I’m jubilant,” said Rev. Roland Stringfellow of the Pacific School of Theology in Berkeley. “When it comes to equality, this is something we preach.”

He adding that his church had been performing same-sex marriages since the 1970s, and that he eagerly awaits legal recognition of his own union with his partner.

Sup. Scott Wiener acknowledged, “the fight is not over yet.”

But he said, “Every so often we get a court ruling that reaffirms our faith in the judicial system…this is a time for us to come together and celebrate.”

California political leaders issued several statements praised the court’s decision.

“The court has rendered a powerful affirmation of the right of same-sex couples to marry. I applaud the wisdom and courage of this decision,” said Gov. Jerry Brown.

Mayor Ed Lee issued a statement saying:
“I celebrate the decision by the Ninth Circuit Court today. This is a great day for marriage equality and a great day for California families. The Court affirmed today that there is nothing in the Constitution that allows discrimination and we are on our way to protecting the fundamental rights of everyone in our State. And, we will continue the fight until everyone is treated equally.  

“San Francisco stands ready to begin marrying same sex couples, and we remain as deeply committed to the fight for marriage equality today as we did nearly eight years ago when then Mayor Gavin Newsom started one of the most important civil rights issues of our generation to ensure equality for all.

“I would also like to acknowledge the tireless work of our City Attorney Dennis Herrera and his team in defense of marriage equality and the California Constitution these last eight years. Together, we will take this fight all the way to the nation’s highest court, if necessary.”

Conflicted Chron buries the lead in city corruption case

UPDATE 2/15: READ OUR CURRENT STORY ON THE CASE HERE. The San Francisco Chronicle’s Matier and Ross love to poke snarky fun at progressives such as Matt Gonzalez, as they did again today when they wrote about his work on the Cobra Solutions vs. San Francisco case, for the second time. But they waited until the last paragraph in this second-to-last item in their column to reveal the real news: Mayor Ed Lee was deposed in the case last week and may be called as a witness.

Wow, talk about burying the lead. Here you have a sitting mayor implicated in a major corruption scandal – acting on orders from then-Mayor Willie Brown, who last year helped elevate Lee into Room 200 (and who just happens to write a weekly column for the Chronicle) – in a case that could cost city taxpayers $16 million.

The Chron hasn’t really covered the substance of the case, but Guardian readers may remember our investigative report on it last year. That’s when we unearthed evidence that Ed Lee, who was the city purchaser at the time, approved a fraudulent city contract – overruling city staff in the process – allegedly on orders from Brown.

It’s a complicated case and a long story well worth reading, but essentially it involves a company called Government Computer Sales Inc. (GCSI) that had ties to Brown. It’s accused of improperly getting a multi-million-dollar city contract with Lee’s help and then soliciting kickbacks from its subcontractors, including Cobra Solutions.

Cobra claims it didn’t know payments to GCSI were kickbacks and that it was damaged by the accusations and being frozen out of its city work by the City Attorney’s Office (under Dennis Herrera, who has his own interesting conflicts in the case). Also implicated in the case are SFPUC Director (and then-Controller) Ed Harrington; Monique Zmuda, still a top official in the Controller’s Office; and Steve Kawa, the chief-of-staff for Lee, Brown, and Gavin Newsom, and a powerful player at City Hall.

In a deposition, a city computer operations manager named Deborah Vincent-James testified that she and other city staffers knew GCSI was a fraudulent company, but that they were placed in the Computer Store (a list of qualified city contractors) to do work for the Department of Building Inspection on orders from above: “[Lee] was directed by the Mayor’s Office and told to do an evaluation process. They evaluated them. They were put in the store.”

UPDATE 2/7: Mayor Lee took the witness stand in court yesterday, where he was questioned by attorney Whitney Leigh about overruling staff to certify GCSI, which the City Attorney’s Office has deemed a fraudulent company that has since left town and evaded justice. More on what he said later.

Gavin Newsom (suddenly) cares about economic justice

I was eating my (late) breakfast as I was listening to Gavin Newsom on KQED’s Forum this morning, and at first it was just the usual lofty rhetoric about education … and then Michael Krasny asked the lieutenant governor about the Occupy movement, and I almost threw up my whole wheat bagel and peanut butter.

Cuz Gav — the mayor who would never even consider asking the city’s wealthiest to pay more taxes, who ran for governor and then lite gov on a platform that he’d balanced the city budget without raising taxes, the guy who was a great friend of the city’s 1 percent, had the nerve to sing the praises of Occupy and complain about economic injustice.

Seriously: Gav ranted on for about five minutes about how low the taxes are on rich people. He announced that his company just set up a new winery and hired a bunch of people — and taxes were never an issue. He acted like someone who reads my shit.

One of the messages of Occupy — and one of the reasons that the movement exists not just in Washington and Manhattan but in cities all over the country — is that economic injustice needs to be addressed everywhere. It’s not just about the Bush tax cuts or even Jerry Brown’s tax-hike initiative; it’s also about local government trying to address the wealth and income gap and the impacts of 1 percent domination — at home.

Gavin had seven years to do that. He didn’t even try. Worse, when the progressives on the board tried, he’d veto anything that remotely smacked of a tax hike on the rich or a way to force the 1 percent to share the wealth with the 99 percent. (Does anyone think he would have allowed Occupy to stay at Justin Herman Plaza as long as Ed Lee did? Not a chance.) Now he wants to take advantage of the popularity of the movement for his own advancement.

Fucking sick.

America’s cup: What does Larry get?

The development agreement for the America’s Cup comes out next week, although the project is already under way. But there’s some concern that the number of visitors (and thus the revenue to the city) might not be as high as projected.

The project EIR is more conservative about the possible number of visitors than city officials had been at first, and now the Bay Citizen reports that “doubts are growing about the number of spectators who will actually come to the city this year and next.” Apparently the prelims in San Diego have been a bit of a bust — and there aren’t as many teams signing up for the challenge.

So here’s the question: If the city winds up taking in less money than expected, does Larry Ellison take a bath, too?

Of course, it’s not that simple: Ellison’s getting a lot from the city, but it’s not based on any revenue the city will get from the cup; it’s based on the investment he’s putting into the port. He’s getting a sweet deal from San Francisco — way too sweet in my mind. The guy’s the sixth-richest person in the world; he doesn’t need all the goodies the city’s handing over, and I’m not sure I want the arrogant, aggressive CEO of Oracle determining the future of a large part of the San Francisco waterfront. But in theory, since he’s renovating property that’s falling apart, he gets something in return.

And, as Jane Sullivan, the spokesperson for the America’s Cup project at City Hall, points out, the fewer the visitors, the lower the city’s costs.

She also told me that “we don’t think the number of competitors will affect the number of visitors,” which is probably true — people will come for the spectacle, and Oracle will hype it beyond imagination, and nobody knows who any of these other teams are anyway. (The one team that might have gotten some press, aside from Oracle, wasn’t allowed to put in an application.)

But here’s the thing: This entire project, and the motivation to give Larry Ellison a bunch of really valuable city property, was the economic impact the cup is supposed to have on the city. The Mayor’s Office has been throwing around numbers like $1.4 billion in economic impact — that’s new jobs, full hotel rooms, packed restaurants, spillover employment benefits — and, of course, more tax revenue to the city coffers.

What it we give away the store to the Oracle pirates and we wind up getting a lot less money than we were hoping for? Nothing against the Cup; I love boats, and I love a big party (although I try to make sure that when the party’s over, I’m not completely broke). But it seems to me that the city’s the only one taking the risk on the downside. Larry gets everything he wants no matter how this all turns out.

We won’t know all the details until we see the agreement, but am I the only one worried about this?

 

But doubts are growing about the number of spectators who will actually come to the city this year and next to watch the races of experimental catamarans. Preliminary races held on 45-foot vessels in San Diego and elsewhere are failing to attract expected crowds or sponsors.

District lines: a community alternative

Early in April, a nine-member task force most San Franciscans have never heard of will draw lines that could change local politics for a decade. The Redistricting Task Force is using the 2010 U.S. Census data to adjust supervisorsial districts to reflect changes in the city’s population. Some shifts are dramatic — the area now covered by District 6 has some 25,000 new residents, and will have to shrink. Others will have to grow. And the way the new boundaries are set could affect the representation of ethnic groups, the political leanings of the board members, and the ability of progressives to pass legislation.

The task force has held a series of hearings on individual district lines. The S.F. Board of Realtors and other downtown groups are drawing their own maps. But almost nobody on the left has been looking at the city as a whole and how the different district lines can impact our ability to get six votes.

As campaign consultant David Looman puts it, “what downtown wants is clear — they want to quarantine all the progressives in districts five, six and nine, so they can control the rest.” What do the rest of us want?

The Guardian held a forum on the topic Jan 26, and about 70 people from across the wide rainbow that is the city’s progressive moment attended. The goal: To create a community alternative to what downtown, the Mayor’s Office, and possibly a majority of the task force members is suggesting.

The map above represents a first draft. Fernando Marti, a community architect and housing activist, did the heavy lifting, looking for ways to keep ethnic communities, neighborhoods, and other so-called communities of interest together, while still avoiding the downtown quarantine.

It’s not an easy task, and there was a lot of discussion around some of the lines. Many of the people in the room were unhappy with the border between District 8 and District 6; in the next draft, that will probably be moved back from Valencia to Guerrero.

There was discussion about whether Japantown should be in District 1 or District 5, whether Portola should be in District 9 or split up, how the District 6 lines should be drawn, and much more.

It’s a work in progress — but we’re publishing it to get some feedback, to let people know that the process is going on, and to let progressive and independent neighborhood activists know that the task force decision, which can’t be appealed or overturned, is critical to the city’s future.

Transfer of power

Feb. 1 marks the first day that San Francisco and other California cities no longer have redevelopment as a tool for building affordable housing or dealing with urban blight, but questions remain about how the power and functions of the San Francisco Redevelopment Agency (SFRA) will now be used.

On Dec. 29, the California Supreme Court upheld the validity of Assembly Bill 26, which dissolved all redevelopment agencies throughout the state and redirected the property tax revenue they accumulated to prevent deep cuts to public schools.

Redevelopment agencies, established in California in 1948, were charged with revitalizing “blighted” areas of cities. There were 400 such agencies throughout California, funded by incremental increases in property taxes within a redevelopment zone. Agencies could borrow against that revenue source to subsidize development projects.

AB 26 mandated that all cities dissolve their redevelopment agencies by Feb. 1 and transfer assets to successor agencies meant to “expeditiously wind down the affairs of the dissolved redevelopment agencies,” according the bill’s text.

A resolution passed by the Board of Supervisors on Jan. 24 authorized the transfer of SFRA affordable housing assets to the Mayor’s Office of Housing (MOH) and its non-housing assets to the city’s Department of Administrative Services. It also created a board to oversee the implementation of the SFRA’s ongoing projects.

Now, San Francisco is faced with the task of continuing to fund affordable housing projects and other development without the SFRA, and the board’s resolution laid out some of the terms for how the city will do that, although much remains to be determined.

Mayor Ed Lee appointed all members of the oversight board, which includes Planning Director John Rahaim; MOH Director Olson Lee; Nadia Sesay, director of the Mayor’s Office of Public Finance; and Bob Muscat, director of International Federation of Professional and Technical Engineers, Local 21.

In recent weeks, some groups have raised concerns that these appointees are not representative of the communities impacted by the ongoing redevelopment projects that they will be entrusted with overseeing, and that too much power is concentrated in the Mayor’s Office.

“One of our biggest concerns is that the oversight body could be made much more accountable and democratic,” said Jeron Browne of People Organized to Win Employment Rights (POWER)-Bayview. Much of Bayview-Hunters Point is no longer under the authority of the Planning Commission or any regular zoning laws since it was declared a redevelopment project site in 2000.

Sup. Malia Cohen, who represents the area, added an amendment to the board’s resolution that would impose term limits on oversight board positions. “I understand that there are a number of concerns that have been raised about the composition of the board. However, given the short time frame and the technical nature of the board and its obligations, I’m very comfortable with these appointees that they will be able to make decisions necessary to make the projects move forward. Additionally, with the inclusion of staggering terms we will be able to ensure that there is ample opportunity to include representation from affected communities,” Cohen said at the meeting.

The board also passed an amendment to “clarify that the land use controls granted by the oversight board are consistent with previous land use authority granted by the Board of Supervisors and the redevelopment commission,” as a response to concerns that the oversight board will have too much power over land use in project areas.

Tiffany Bohee, interim director of the SFRA, said that the court’s ruling was the “least desirable possible outcome.” Bohee said the SFRA has spent recent weeks analyzing all enforceable obligations outlined by the ruling to make sure that the transition complies with the law and is as fair as possible to SFRA employees.

The positions that these 101 workers filled at the SFRA will no longer exist as of Feb. 1, and layoffs are underway. However, most will remain employed throughout a transition period that ends March 31, and Bohee said that many will find work in city agencies that will be charged with continuing the work of the SFRA, such as MOH and the Planning Department.

MOH was historically responsible for allocating federal housing grants to city agencies. In past decades, federal budget cuts have severely limited the grants to build affordable housing. Now, although MOH has some power over city housing policy and allocation of funds to build housing, many of those responsibilities had been transferred to the Planning Department — or, until recently, the Redevelopment Agency.

The Planning Department is governed by the Planning Commission with four mayor-appointed members and three members appointed by the Board of Supervisors. The Planning Department implements planning standards and signs off on structural changes to the city, ranging from homeowner requests to alter houses to developer requests to build high-rises.

In many ways, the Redevelopment Agency was redundant, shadowing work done by the Planning Department. When an area was designated an SFRA project area, the planning code and zoning restrictions no longer applied, and developers working in partnership with the city had the power to define new land-use regulations.

Many critics of the SFRA said that private developers were able to use this lack of regulation to take advantage of the significant amount of money reserved for the agency. Deepening this concern was the fact that the Redevelopment Commission, which oversaw the SFRA, was composed entirely of mayoral appointees, which some felt were less accountable to the public interest than the Planning Commission.

Some feel that the oversight board, composed entirely of mayoral appointees, will repeat the same lack of accountability to neighborhoods.

“The city is setting up a planning commission for the 1 percent. And the Planning Commission that we have is the for the 99 percent,” said Tom Radulovich, executive director of Livable City, which works on land use issues. He said that with the dissolution of the SFRA, the city has an opportunity to facilitate the construction of affordable housing in a more democratic fashion. His organization expressed concerns to the Board of Supervisors, cautioning that the Oversight Board should not have undue power over land-use in development project areas and that the new structure in city government for facilitating development projects should be created with the input of communities. The Board of Supervisors made clear Jan. 24 that the Oversight Board and its appointees are a temporary measure to comply with AB26 by the Feb. 1 deadline. As Sup. Christina Olague said, “I just want to assure the public that this isn’t the end-all, be-all of this discussion, that it will be ongoing, and we welcome any of your concerns at any time.”

After the tear gas clears

After a chaotic day of marches and confrontations between police and protesters Jan 28, I was arrested along with about 400 others who were trapped by police in front of the downtown Oakland YMCA. Seven of us were journalists.

The goal of the march was to take over an abandoned building — an the vacant Kaiser Convention Center, a city-owned building that’s been closed since 2005, was a prime target.

I have not yet been able to retrieve my property, including my recorder and notebook, which is being held by the Oakland Police Department. What follows is a pieced-together account and a perspective on what the events of Jan. 28.

I spend 20 hours behind bars, and missed the later parts of the action. But I was able to observe what happened in jail and make some sense of what happened.

Occupy people are constantly debating tactics and goals, and for many, the idea of occupying a vacant building made sense. When Occupy Oakland had a camp in Frank Ogawa Plaza, also known as Oscar Grant Plaza, and commonly shortened to OGP, it created a strong community. That community bridged divides between the homeless and the housed, between students and labor organizers, and between Oakland residents of different races, genders and levels of ability in an unprecedented fashion.

The camp had a kitchen that fed hundreds of people everyday and a network of shared tents and blankets which welcomed in hundreds who otherwise would have slept on the streets, often feeling isolated from other residents of their city and made to feel inferior.

The camp was repeatedly raided, Occupiers were tear gassed and shot with rubber bullets, and when OGP was cleared out, the community no longer had a home. And the police started that violence.

That was the practical reason for wanting to occupy a vacant building: to have a social center for Occupy Oakland.

Of course, there are other reasons. There’s the question that many squatters and homeless advocacy groups have been making for decades: why let buildings lie vacant while people freeze on the street?

Remember: The building that Occupy wanted to occupy is public property, and right now nobody is using if for anything.

In one exchange in jail, a guard asked a protester why the activists thought they had the right to take over a vacant building. “I mean, it’s not yours,” he insisted. The protester replied that many vacant buildings are government-owned and therefore public.

“So it’s the government’s,” the cop said.

“But I pay taxes,” the protester responded.

“Me too!” replied the cop. “It’s mine!”

“It’s both of ours,” smiled the protester. “It’s all of ours.”

That’s what made the convention center action such a clear and easy political decision.

A lot of people in Occupy would go further, saying that at a time of a severe housing crisis, it’s perfectly legitimate to take over privately owned buildings that are sitting there vacant. It’s part of the central argument of Occupy — that corporations and the rich unfairly own and continue to acquire much more wealth than the majority of people. For many people, owning a vacant building and doing nothing with it, while hundreds freeze on the streets, is a crime itself.

 

UP AGAINST THE COPS

Then there’s the question of the police — and violence.

The word “nonviolent” has a specific meaning in the history of political movements. Martin Luther King Jr. defined it in his essay “The Meaning of Non-Violence”: “If you are hit you must not hit back; you must rise to the heights of being able to accept blows without retaliating … But it also means that you are constantly moving to the point where you refuse to hate your enemy. You are constantly moving to the point where you love your enemy.”

It’s a philosophy but also, in political terms, a tactic.

Many of the people who make up Occupy Oakland get their start as activists organizing against police brutality in a city that has longstanding problems with violent and undisciplined officers.

Police Chief Howard Jordan said in a press release that “It became clear that the objective of this crowd was not to peacefully assemble and march, but to seek opportunity to further criminal acts, confront police, and repeatedly attempt to illegally occupy buildings.”

It was certainly clear that the intent of the crowd was to illegally occupy a building. And any honest assessment of Occupy Oakland would have to acknowledge that some members are not wedded to King-style nonviolent civil disobedience. (Neither, by the way, were a lot of the protest movements of the 1960s.) Many protesters wore masks and bandanas to disguise their identities and protect them from tear gas and pepper spray, and the march was led by protesters with makeshift shields, which suggests that they expected to be attacked. You could certainly argue that what those people were doing wasn’t confrontation; it was self-defense.

Frankly, it made sense to be prepared: In other Occupy Oakland actions, police have attacked with batons, tear gas, pepper spray, flash-bang grenades, and smoke bombs. And for quite a few Oakland residents, the police have always been seen as an outside force that can’t be trusted.

In fact, violence did break out. Many, including myself, have eyes still stinging from tear gas. I saw several wounds caused by rubber bullets shot at protesters. I spoke individually to at least a dozen people — one of them a pregnant woman — who were struck with police batons.

And protesters did not remain peaceful while this violence was being used against them.

Some picked up tear gas canisters and threw them back towards police; that much I saw. I also saw protesters throw empty plastic bottles at police.

According to the police, they also threw metal pipes, rocks and bricks. According to the protesters, they threw mainly empty plastic bottles and fruit at police. But as protesters often say of the police, “They’re the ones who showed up with the guns.” If the cops didn’t want violence, why unleash such an arsenal of weapons?

People got hurt, protesters and police alike. Several bystanders who had nothing to do with the situation were swept up in the mass arrest.

The city of Oakland, already in dire financial straits, likely spent hundreds of thousands of dollars reacting to the protests. Police claim that they were unable to sufficiently respond to violent crimes over the weekend, including five murders, because they were overwhelmed with Occupy troublemakers.

Of course, city officials were the ones who decided to arrest 400 people — with all the expense that involves.

There are, at this point, no reports of serious injuries to any police officers. However, at least a dozen protesters had welts on their faces or bodies from being beaten by clubs or shot with rubber bullets. One woman was shot in both arms with rubber bullet; one man was shot in the face with rubber bullets while holding a video camera to document the events. Several protesters were shoved to the ground and received wounds on their faces while being arrested. Police raised their rubber-bullet rifles to the faces of protesters throughout the day, threatening attacks. A rubber bullet to the face can cause brain damage and blindness.

 

 

DID IT HAVE TO HAPPEN?

How could this have been prevented?

Police say that “while peaceful forms of expression and free speech rights will be facilitated, acts of violence, trespassing, property destruction and overnight lodging will not be tolerated.” But 40 people were arrested during an ongoing Occupy Oakland vigil in the first weeks of January for having “illegal property” at OGP in what many saw as clearly a peaceful expression of First Amendment rights.

On KGO radio Jan. 29, Chief Jordan said that he has allowed Occupy Oakland to protest without a permit and would continue to do so, but those early January raids were ostensibly due to permit violations — violations of the terms of a permit that Occupy Oakland did in fact have.

There’s no question: The police response to Occupy Oakland over the past few months has caused some people in the movement to get more radical.

Many Occupy Oakland-affiliated medics condemned those who threw objects at police, saying that they provoked a backlash that caused more injuries. Many Oakland residents who might be in line with the socio-economic critique presented by the Occupy movement feel endangered and confused by marches that result in the massive use of police weapons in broad daylight. A lot of people would rather protest in a lot of ways that less resemble urban warfare.

On the other hand, there are also ways that Oakland officials could have prevented the consequences of weapons deployed and 400 arrested Jan. 28. They could, for example, have allowed protesters to occupy the vacant building.

When protesters seized a building Jan. 20 in San Francisco, police first attempted to prevent them. They lined up in front of the targeted building. They deployed pepper spray and struck several protesters with batons. When they were unsuccessful, and protesters entered the building from the back, they opted to block the surrounding streets and wait until the time seemed right to enter the situation and make arrests. Police spokesperson Carlos Manfredi told me that the cops were not going to rush into the situation and were trying to prevent injury and violence.

The Kaiser Convention Center has been vacant for years. The city of Oakland recently made plans to sell it to its Redevelopment Agency, but that plan fell into legal limbo when Gov. Jerry Brown signed AB26, a bill that dissolved all California redevelopment agencies.

At this point, nobody at Oakland City Hall has any plans whatsoever for the big, empty structure.

Why not allow Occupy to use the convention center? It’s not downtown, where Mayor Quan says businesses have been adversely affected by Occupy Oakland’s presence. It would give the movement a chance to stop focusing on trying to occupy spaces and start focusing on benefiting the community with food, shelter, and community programs that they provided when they had a camp. It would give the building tenants who could be held responsible for maintaining it. It might even help get Occupy Oakland and the Oakland Police Department out of the cycle of violence that they have been spiraling into for months.

Each time arrests occur, each time violence occurs, both sides blame the other. Both sides are correct that they were provoked. Both sides are correct that something that they think is worth defending was violated — for the cops, it’s the law. For the protesters, it’s the right of the people to assemble.

In fact, many Oakland residents have experienced violence at the hands of the Oakland Police Department for years before Occupy began. There was already a mass movement formed around the murder of Oscar Grant, and thousands of people fed up with police murders of unarmed, often black, suspects.

In recent decades, other radical groups, notably the Black Panthers, insisted that their community lacked basic needs because the city of Oakland refused to prioritize them. The Black Panther free breakfast program served food in a strikingly similar way to Occupy Oakland. Black Panthers were also notorious for carrying guns to defend themselves against police violence.

Occupy Oakland protesters (unlike Tea Party members) certainly don’t carry guns. But, more and more, they cry “fuck the pigs” as much as any Panther.

For much of the Occupy movement’s 99 percent, unjust actions by banks, corporations, and the government officials that they have often bought and paid for are the worst problems facing the United States today. For others, particularly the poor and people of color, these problems are magnified and exacerbated by the fact that they feel the threat of police harassment every day. For years, they’ve understood that police disproportionately do not investigate or solve crimes that happen to them and their families.

 

 

THE RADICALS AND THE BROADER MOVEMENT

The Oakland General Assembly Jan. 29 was the biggest it’s been in weeks. While there were still over 300 people in jail, 300 more came out to get involved with the meeting. That happened at the same time that many who felt that inexcusable violence and property destruction occurred Jan. 28 and concluded they could no longer have anything to do with Occupy Oakland.

It’s a challenge for the movement nationally, too: How do you accept and encourage the people whose legitimate anger at economic injustice and police abuse turns them toward more radical responses — and at the same time make room for a people who want nothing to do with the black bloc Fs, vandalism, and confrontation with the police?

There are tactical issues with the way the building occupation was planned. Many who were completely in line with the concept felt unsafe and uncomfortable with the secretive nature of the organizers who planned it. The location of the building targeted for occupation was kept secret for practical reasons; police could easily prevent a successful takeover. Supporters must often be led to the locations of planned takeovers without knowing where the action is and how they’ll get there. But how do you reconcile this with the transparency required when organizers are leading more than 1,000 people who want to use tactics they feel comfortable with and make their own choices?

Occupy Oakland is asking the people to imagine a world where property rights wouldn’t prevent them from doing all the good that they could do with a building like the Kaiser Convention Center. They must also ask themselves to imagine a world in which goals like a building occupation can be achieved in a way that everyone involved is able to consent to their involvement.

These debates continue to occur at Occupy Oakland. Some will leave the movement, some will join. Some will take the ideas and try to manifest them in new and different ways. Participants in Occupy Oakland desperately want basic needs of food and shelter met for their community members, and for the system that governs the city to do so in a way that allows people to thrive when it comes to health, education, and opportunities for creativity and growth. They think that they have the beginnings of a community and a process that can achieve those visions, better than the city government ever has, and they care more about achieving it than respecting the property rights of the owners of abandoned buildings.

First course, by Boyle, is a nicely acted but fairly drab comic soufflé that tastes pretty familiar. Its setting is a restaurant turned upside down by the ambition of its portly, middle-aged, married chef (Soren Oliver), obsessed with winning over the big paper’s notoriously dismissive and all-powerful food critic (Molly Benson), who turns out to be a secretly insecure bombshell with a perennial dinner companion nicknamed The Palate (Gendell Hernandez). Fisher’s cast comes together well after a few hiccups, and the staging, while sometimes erratic, includes some inspired moments. But the story as a whole has little more to it than the food-as-sex seduction we see coming early on, and consequently lacks any real suspense. More satisfying all around is McDermott’s Enough, a salty, well acted, and fluidly staged condensation of a single lifetime — bracketed by scenes of eager tonguing of ice cream dregs. In this family history of a sweetly sybaritic but otherwise ordinary American woman (played variously by Delia MacDougall and Patricia Silver) food and sex are intertwined again but hardly, as the author stresses, in a metaphorical sense: “Pleasure is pleasure,” after all, and life is good to the last drop. (Avila)

Wed/1-Sat/4, 8pm (also Wed/1 and Sat/4, 2pm); Sun/5, 2pm. “This is a show about clowning,” Lorenzo Pisoni advises his audience at the outset of his graceful solo performance, “and I’m the straight man.” It’s a funny line, actually — funny because it’s true, and not true. In the deft routines that follow, as well as in the snapshots cast on the atmospherically dingy curtain hung center stage, the career of this Pickle Family Circus brat (already alone in the spotlight by age two) never veers far from the shadow of his father. That fact remains central to the winning comedy and wistful reflection in Humor Abuse. Reared in the commotion and commitment of the famed San Francisco circus founded by his parents Larry Pisoni and Peggy Snider, Lorenzo had a childhood both enviable and unusually challenging. The fact that he shares his name with both a grandfather and his dad’s famous clown persona is instructive. His trials and his triumphs are further conflated — along with his father’s —in such elegant catastrophes as falling down a long flight of stairs. And in his good-humored and honest reflections, the existential poignancy at the heart of such artful buffoonery begins to rise to the surface. The spoken narrative feels a little pinched or abbreviated, in truth, but there are no shortcuts to the skill or wider perspective inculcated by the charming Pisoni and (under direction of co-creator Erica Schmidt) set enthralling in motion. If the thought of someone as perennially irreverent, insouciant, and appealingly immature as Gomez makes you depressed, the show is, strangely enough, the best antidote. (Avila)

The fuchsia papier-mâché tree and swirling grey-on-white floor pattern (courtesy of scenic designer Richard Colman) lend a psychedelic accent to the famously barren landscape inhabited by Vladimir (Keith Burkland) and Estragon (Jack Halton) in this production of the Samuel Beckett play by newcomers Tides Theatre. Director (and Tides’ producing artistic director) Jennifer Welch layers the avant-garde classic with some audio accents as well (although Jon Bernson’s minimalist industrial soundscape is a bit low in the mix to be very effective). More compelling is the gentle, sad humor and couched intelligence captured expertly by Halton in the circular but deliberate rhythms of his hapless tramp. Burkland as pal Vladimir exudes a palpable presence as well, though lacks the same focus. Timing is all in vaudeville — the parallel universe from whence these tangible modernist archetypes hail — as well as in a play whose plot goes intentionally nowhere, or rather loops back on itself in an implied dance with eternity. The halting aspect to Tides’ staging gets compounded with the arrival of brash whip-cracker Pozzo (a suitably stentorian but inconsistent Duane Lawrence) and his pitiful slave Lucky (a haunted, generally sharp Renzo Ampuero, made up to look like a goth doll à la some Tim Burton movie). That said, the best moments here broadcast the brooding beauty of the play, with its purposely vague but readily familiar world of viciousness, servility, trauma, want, fear, grudging compassion, and the daring, fragile humor that can look it all squarely in the eye. This new autobiographical solo show by Don Reed, writer-performer of the fine and long-running East 14th, is another slice of the artist’s journey from 1970s Oakland ghetto to comedy-circuit respectability — here via a partial debate-scholarship to UCLA. The titular Los Angeles residency hotel was where Reed lived and worked for a time in the 1980s while attending university. It’s also a rich mine of memory and material for this physically protean and charismatic comic actor, who sails through two acts of often hilarious, sometimes touching vignettes loosely structured around his time on the hotel’s young wait staff, which catered to the needs of elderly patrons who might need conversation as much as breakfast. On opening night, the episodic narrative seemed to pass through several endings before settling on one whose tidy moral was delivered with too heavy a hand, but if the piece runs a little long, it’s only the last 20 minutes that noticeably meanders. And even with some awkward bumps along the way, it’s never a dull thing watching Reed work. (Avila)

Two clean energy tracks for SF

OPINION CleanPowerSF, San Francisco’s green electricity alternative to Pacific Gas and Electric Co., is set to launch this year. The program is following two parallel paths — one to build renewable energy in San Francisco and create thousands of local jobs, the other to purchase clean power from remote sources from Shell Energy.

While both tracks bring advantages, this bifurcated approach could end up serving only 30 percent of city residents. Fortunately, the city can easily improve the launch of CleanPowerSF by merging the two tracks.

Enacted by the Board of Supervisors and Mayor Gavin Newsom in 2004 and in 2007, CleanPowerSF is not a public-power program like Santa Clara’s Silicon Valley Power or Alameda Municipal Power. CleanPowerSF is a public-private partnership, much like the successful Marin Clean Energy, which can buy power in bulk from outside companies — and also generate its own renewable energy. PG&E still owns the transmission grid and will deliver electricity to customers, who then have the option of choosing between CleanPowerSF and PG&E.

The San Francisco Public Utilities Commission has embarked on a detailed analysis of PG&E electricity data to find out how much electricity is used in different parts of the city at different times of the day and how much it costs. That will pinpoint exactly where in San Francisco renewable energy should be built for the highest efficiency and lowest costs to ratepayers.

While this analysis is being conducted, the SFPUC plans to initiate the second track, offering ratepayers 100% renewable electricity purchased from Shell Energy North America. That will get CleanPowerSF up and running quickly — but would cost ratepayers between $6.70 and $54.50 more a month more than PG&E. As a result, the SFPUC estimates that as many as 70% of ratepayers could leave CleanPowerSF and go back to PG&E.

The SF PUC plans to offer CleanPowerSF to two-thirds of San Francisco customers — 230,000 residences — with as many as 155,000 opting out. Once these people opt out, they won’t be customers of the cheaper, locally produced, job-creating, green energy that will come later.

By comparison, only 20 percent of Marin Clean Energy customers opted out at initial rollout. That’s because Marin Clean Energy offers a 27 percent renewable energy option in addition to a higher-cost 100 percent green option. The “light-green” option is cheaper because it mixes in lower-cost, non-renewable electricity.

The PUC could keep more San Franciscans in CleanPowerSF by integrating the local generation and data analysis and purchasing tracks. First, it could include a cheaper light-green option like Marin’s. To determine what mix of renewable and non-renewable electricity would be cost-competitive with PG&E, the PUC would use the results from the first track, the analysis of electricity usage data, expected this spring. The Board of Supervisors could make these changes when it takes up the Shell contract this month or next.

In the past few months, CleanPowerSF has made much progress thanks to San Francisco Supervisor David Campos and Ed Harrington, general manager of the San Francisco Public Utilities Commission. The addition of a cost-competitive light-green option would enable CleanPowerSF to better compete with PG&E and keep more San Franciscans in the program — for the long term. That would significantly increase the number of new local jobs created and have a greater effect in fighting global climate change. It worked in Marin, and it can work in San Francisco as well..

I used to go to Grateful Dead shows at the Oakland Auditorium, which is now called the Kaiser Convention Center. One night I saw Bill Graham, the late concert promoter, ride a zip line from up near the ceiling to the stage in a giant paper mache joint called the “S.S. Columbian,” which looked like it was going to fall apart at any minute as he swung back and forth 50 feet over the crowd, trying to smile and wave in a bizarre promotional stunt that confused even the deadheads. I bet he shit his pants.

The place was a pretty good venue for a big concert, but it never worked out as a convention center, and the city shut it down in 2005. It needs seismic work and about $5 million in maintenance. It sits near Lake Merritt, on the edge of downtown Oakland, a giant empty building just waiting for something to happen to it.

It’s a perfect spot for an Occupy Oakland headquarters. I’m surprised it took the Occupy folks this long to figure it out.

Look: Oakland’s a working-class city, and it’s having severe financial problems, and sending hundreds of cops to arrest Occupy protesters is sucking up money that’s desperately needed for other things. Mayor Jean Quan complains that police were unable to respond to emergency calls in other parts of the city because they were all downtown dealing with the demonstration.

Understood — and it’s clear that the Oakland Police, whether the Occupy folks like it or not, are going to arrive in mass numbers to make sure that there’s no damage to local businesses or City Hall (where, oddly, there were no arrests, because the cops were elsewhere).

But the empty Kaiser Center, which isn’t even in the downtown center? Why bother?

Seriously: Why not just give it to Occupy Oakland? Tell the group that the city will strictly enforce fire and health codes, that the Occupy people will have to clean the place up and keep it clean, that they can’t damage the place … and hand over the keys?

It’s public property. Nobody using it now. Occupy might actually bring some excitement to the scene. If it became a center for political meetings and organizing, for education and performances, it could be a be a very positive thing.

Declare at truce in the Occupy wars. Let the cops go after murderers; give Occupy the vacant convention center. Nothing else is working. It’s worth a try.

Inside the Occupy Oakland protest

UPDATE: We’ve corrected a few factual mistakes. We originally reported that protesters forced open the door of the YMCA; in fact, they asked to be let in and they were. We regret the error.

An Occupy Oakland march that turned violent Jan. 28 led to the arrest of 400 people, including me.

The march, which peaked at about 2,000 protesters, was organized with the intention of entering a vacant building — the Kaiser Convention Center — and turning it into a new “Social Center” that participants in Occupy Oakland hoped to use to gather, teach, and organize.

The move was more than symbolic. Occupy activists have engaged in constant debate about tactics and goals, particularly when it comes to violence and property destruction, and it’s hard to argue at this point that Occupy Oakland is a nonviolent movement.

But many thought that the goal of occupying a vacant building made sense. When Occupy Oakland had a camp in Frank Ogawa Plaza, also known as Oscar Grant Plaza, commonly described as OGP, it created a strong community. It’s a community that bridged divides between the homeless and the housed, between students and labor organizers, and between Oakland residents of different races, genders and levels of ability in an unprecedented fashion.

Besides that, the camp had a kitchen that fed hundreds of people everyday. The camp had a network of shared tents and blankets that welcomed in hundreds who would have slept freezing on the streets, often feeling isolated from other residents of their city and made to feel inferior. Now, they had a place to stay that was warmer, more safe and secure, and was embedded in a community bound together by ties of solidarity.

That community was able to thrive in it’s centralized camp location.

That was the practical reason for wanting to occupy a vacant building: to have a social center for Occupy Oakland.

Of course, there are other reasons. There’s the question that many squatters and homeless advocacy groups have been making for decades: why let buildings lie vacant while people freeze on the street?

The march set off from OGP at 1 p.m. Jan. 28. There was no ambiguity about group’s goal: Many pushed carts stacked with furniture, hoping to furnish the new center; others held a large banner reading “Vacant? Take it!” 

Many other Occupy groups around the world, including protesters in Washington DC, London, England, and Belfast, Ireland, have taken over vacant buildings in an attempt to create social centers, house homeless community members and protest injustice symbolized by buildings lying vacant while people live on the street.

In Oakland, the attempts were staved off when riot police lined up in front of the march and declared unlawful assemblies.

In front of the  Convention Center, police threw smoke bombs into the crowd and warned that those who refused to disperse would be arrested. The march continued around the corner to 12th St and Oak, where protesters and police were involved in another confrontation. Police shot smoke bombs and “pepper bombs,” canisters of pepper spray that explode on impact, into the crowd. Some in the march responded by throwing canisters, along with plastic bottles, back at police. Masked protesters in the front of the group brandished makeshift shields. Protesters say the shields were there to protect them from rubber bullets and bean bag rounds.

The cops had a different perspective. “It became clear that the objective of this crowd was not to peacefully assemble and march, but to seek opportunity to further criminal acts, confront police, and repeatedly attempt to illegally occupy buildings,” said Oakland Police Chief Howard Jordan in a press release.

In a tense moment, hundreds knelt to hide behind the frontline shields while police fired rubber bullets into the crowd.
When police began to advance at both the front and back end of the group, protesters retreated, marching on 12th St back to Ogawa/Grant Plaza.

As they marched on 12th street, Occupy Oakland-affiliated street medics treated injuries from tear gas, pepper spray, and rubber bullets. Police followed in the rear of the march, continuing to project exploding flash-bang grenades at the crowd.

At about 5:30, another march left from the plaza, again with the stated attention of occupying a building. Police marched behind protesters. When the march cut through Fox Square in Oakland’s Uptown neighborhood, police filled in all surrounding sides of the march. Protesters have used the term “kettling” to describe a situation in which police line up on all sides of a group, blocking anyone in the group from leaving.
After “kettling” hundreds of protesters at this location, police began to deploy tear gas. Some protesters with makeshift plastic and metal shields, many marked with the “circle-A” anarchy symbol, advanced towards police. Several police beat the shield back with batons and struck some protesters.

One 19-year-old woman who was struck with a baton to the kidneys was brought to the hospital and treated for internal bleeding.
At Fox Square, police announced that the gathering was an unlawful assembly. Minutes later, some protesters knocked over a line of chain-link fencing, allowing the march to exit the “kettle.” The march continued on Telegraph.

When the march arrived at Broadway between 22nd and 23rd streets, protesters asked to be let into the YMCA and someone who was in there opened the doors. Police later closed in on both sides until they had formed a line preventing the approximately 400 protesters from exiting.

On Broadway, there was no dispersal order issued. This is in violation of the Oakland Police Department’s crowd control policy, which states that “If after a crowd disperses pursuant to a declaration of unlawful assembly and subsequently participants assemble at a different geographic location where the participants are engaged in non-violent and lawful First Amendment activity, such an assembly cannot be dispersed unless it has been determined that it is an unlawful assembly and the required official declaration has been adequately given.”

About 6:30 p.m., police announced that all of the blocked-in group was under arrest.

It was more than six hours before the sidewalk was cleared of all detainees. Most are charged with failure to disperse. Some, such as those who entered the YMCA, have been charged with burglary.

Dozens of protesters who had avoided arrest marched back to City Hall. There, they illegally entered the building and committed several acts of vandalism. According to a press release, these included “breaking an interior window to a Hearing Room, tipping over and seriously damaging the historic model of City Hall, destroying a case containing a model of Frank Ogawa Plaza, and breaking into the fire sprinkler and elevator automation closet.” Protesters also report setting off fireworks in the counsel chambers.

Some protesters took an American flag from City Hall and burned it in front of the government building.

Oakland officials have complained about the cost of the protests. The city had reportedly spent $2.4 million policing Occupy Oakland protesters as of November 15, just weeks after announcing the decision to close down five elementary schools to save $2 million.
Occupy activists say the huge — expensive — police presence is an overreaction.

“The amount of property damage by protesters has been minimal next to Mayor Quan’s destruction of the humanitarian Occupy Oakland community and excessive force against peaceful people, said Wendy Kenin, an Occupy Oakland spokesperson. “The City of Oakland’s commitment to militarism far outweighs its investment in schools. 

Kenin said she was back at Occupy Oakland outside City Hall, with her four children, the day after the incidents.
There were no arrests made in the City Hall incident, partly because so many police resources were deployed at the YMCA.

Cities and counties that provided police reenforcements to handle the mass arrests include Alameda County, San Mateo County, Santa Clara County, San Francisco County and Marin County and the cities of Fremont, Hayward, Berkeley, Pleasanton, San Francisco and Union City/Newark; and the University of California-Berkeley, according to an Oakland Police Department press release. 

Dozens of those detained were brought to Glenn Dyer jail, which quickly filled up; the rest were brought to Santa Rita jail in Dublin.
Several members of the press, as well as passers-by who were on their way to work in the area, were swept up in the arrests.

In jail, those detained debated tactics involved in the day’s demonstrations and discussed the future of Occupy Oakland.

The number of injured protesters is unknown, but in the 19-person sampling of arrestees with whom I spent 20 hours, two had bruises from baton strikes, one suffered from an injured foot after a pepper-bomb exploded upon impact with her ankle, and most had irritation in their eyes, ears, and throat from exposure to tear gas and pepper spray.

Oakland police report that three officers were injured.

As of the morning of Jan. 30, about 100 remained in Santa Rita.

Mayor Lee’s call for more hearings gets wary reception

Labor and the Left came out strongly against Mayor Ed Lee’s proposed charter amendment to require all city legislation be delayed and subjected to hearings by the Small Business Commission and other commissions if it might cost private sector jobs, putting its prospects of making the ballot in doubt.

 “This legislation is one, unnecessary; two, unbalanced; and three, divisive,” Mike Casey, president of the San Francisco Labor Council – whose executive committee voted unanimously to oppose the legislation – said during today’s Rules Committee hearing on the measure.

He and other labor leaders noted that members of the business community have plenty of opportunities to weigh in on legislation it opposes, but Lee’s proposal would elevate employers’ interests far above those concerning the environment, consumers, public health, or workers. “This legislation gives one stakeholder undue power in the democratic process, which is undemocratic,” said Kate Hegé of La Raza Centro Legal, which represents day laborers and other immigrants.

Teacher Ken Tray of United Educators of San Francisco said, “Often times ‘jobs’ is used as a red herring to divert the city from doing what it needs to do.” It was a common theme, as opponents of the proposal noted that paid sick leave, the local minimum wage, and requiring employee health benefits were all fiercely opposed by the business community. “Anything that raises workers up, we’re told it’s a job killer,” said Larry Bradshaw of SEIU Local 1021.

Small business representatives – a bit sheepishly, given the tenor of the hearing, and without support from their downtown brethren – said they were simply looking for the ability to express their concerns. “We’ve tried to let small business have a voice at the Board of Supervisors,” said longtime small business advocate Scott Hauge, a regular at City Hall.
Keith Goldstein of Potrero Dogpatch Merchants Association said, “We feel we don’t have a say in this process.”

Mayor’s Office board liaison Jason Elliott emphasized that Lee’s charter amendment would create a delay and an extra hearing or two, but that supervisors would still be free to approve the legislation anyway. “This is about public participation and feedback,” Elliott said.

But Sup. David Campos, who led the questioning of Elliott, wasn’t buying it. “What’s the reason behind this? Is there a specific reason the Mayor’s Office has decided to do this now and through a charter amendment?” Campos said, probing for instances in which the Mayor’s Office thought the business community hadn’t been heard.

Elliott continued to say it was about emphasizing jobs and taking more public input, but he couldn’t explain what’s lacking currently or what’s muting employers. Campos thanked the Mayor’s Office for being willing to work with supervisors and accept amendments – including many introduced today, which delayed the vote on the measure until next week.
But Campos questioned the need for the legislation, comparing it to the hollow jobs rhetoric from the current field of Republican presidential candidates. “It’s not just the number of jobs you have, it’s the quality of those jobs,” Campos said.

(Side note: the Mayor’s Office issued a press release today celebrating the first two businesses to take advantage of last year’s controversial mid-Market payroll tax exemption, Zendesk and Pearl’s Deluxe Burgers, which created 56 jobs between them. And to help create those great burger joint jobs, Pearl’s got Redevelopment Agency assistance, a low-interest city loan, and an exemption from the payroll tax. For hiring burger flippers that probably make minimum wage. But I digress…)

Campos said that everyone in City Hall wants to see more good jobs in the city, “but I don’t believe this is a constructive approach.” Sup. Jane Kim echoed the sentiment, saying private sector job creation isn’t the only imperative. “Lowering our minimum wage to $3 or $1 an hour would create plenty of jobs in San Francisco,” she said.

Even the more conservative third committee member, Sup. Mark Farrell, said he tends to agree with his committee colleagues and made the motion to continue the item until next week, when its prospects for passage look weak unless Lee can convince them that there’s more to this measure than just political grandstanding.

America’s Cup moves forward, but economic concerns remain

In past weeks, several environmental and community organizations filed two appeals of the Environmental Impact Report (EIR) prepared for the America’s Cup yacht race in 2013.

Jan. 24, the Board of Supervisors rejected the appeal, allowing for construction on the several major projects contained in the America’s Cup proposal to move forward.

But some supervisors say that the many groups with environmental concerns about the America’s Cup brought up important issues, including economic issues that will still need to be addressed.

Organizations involved in the appeals include San Francisco Tomorrow, Telegraph Hill Dwellers, and the Golden Gate Audubon Society.

The biggest concession regards the jumbotron, a giant TV screen that was planned to project the race’s events. The America’s Cup event authority planned to float the jumbotron’s 44-foot wide screen on a 140-foot barge, and anchor it with large concrete blocks, dropped in Aquatic Park. Opponents said that the blocks would stir up potentially toxic sediments and that the whole plan put Aquatic Park, a preferred beach of bay swimmers, at risk of a diesel spill that would have long-term implications for the safety of its swimmers.

After a heated back-and-forth, attorney for the The America’s Cup event authority Mary G. Murphy stated that the Authority would ditch plans for the water-born jumbotron and look into landside options.

President of the Dolphin Club Reuben Hechanova said that the decision on the jumbotron was a clear victory. The club, whose members have been swimming in the cold waters of Aquatic Park since 1877, was vocal in its opposition for plans for the floating TV. Members of the Dolphin Club and their allies had been meeting with city officials for over a year, campaigning against the jumbotron.

Hechanova denied that Dolphin Club members had planned to disrupt the America’s Cup in a swim-in called “Occupy the Bay” if plans for the floating jumbotron proceeded.

“We were always going to continue to work with the governing agencies…we were not going to occupy the bay. The only official spokespersons of the club are the board members,” Hechanova told the Guardian.

Appellants were also concerned about effects on air quality from cruise ship emissions.

The EIR claimed that these air quality issues would be mitigated with a shore-side power source on Pier 70, but appellants questioned the feasibility of these mitigating measures. Michael Martin of the Mayor’s Office on Economic and Workforce Development commented on the issue, stating that since issuing the report the port, along with its shipyard partner, BAE San Francisco Ship Repair, had in fact secured the 5.7 million necessary for the shore-side power project.

Still, several supervisors remained skeptical about the feasibility of paying for all of the mitigating measures crucial to the adequacy and accuracy of the EIR. Supervisors will vote on these and other financial matters associated with the Cup at a Feb. 14 hearing.

“I have questions remaining about finances, about union jobs that will be created for San Franciscans in this project…as well as assuring that there would be no hit to the general fund,” said Supervisor John Avalos at the meeting’s end.

Other environmental concerns, such as impact on sea and shore birds and on neighborhoods adjacent the America’s Cup area, went largely unresolved.

However, in an amendment proposed by Supervisor David Chiu, the Board made clear that they would require additional environmental reviews, including, potentially, more EIRs, for subsequent projects.

Aaron Peskin, former President of the Board of Supervisors and longtime water rights advocate, has been a vocal opponent of many aspects of the America’s Cup. He said these agreements are a step in the right direction.

“I wouldn’t call it a victory, I’d call it a step. It’s a good step,” said Peskin.

After the appeals had been rejected, Campos thanks all parties involved, including the appellants.

“I do believe that the two appeals that have been filed have clearly made this project better, and not only on the environmental piece. I think the appeals have also raised some very important issues about financial terms of this deal,” said Campos.

This is our country, too: Fred Korematsu’s daughter on her father’s civil rights legacy

“One never knows after someone dies what happens to their legacy. Sometimes it becomes a part of history and sometimes it grows,” Karen Korematsu -remarked in a phone interview with the Guardian this week. Her father, civil rights activist Fred Korematsu, will be honored statewide with his own official day on Mon/30. You can celebrate his legacy locally at the Oakland Museum of California’s Lunar New Year event on Sun/29, where Karen will be speaking about her dad’s contribution to our cultural heritage.

“In the case of my father, his legacy seems to be growing,” Karen continued. “His story resonates and remains important to people.” Last year was the first time California celebrated the Fred Korematsu Day of Civil Liberties and the Constitution. This year, events from a photo exhibition in the Smithsonian National Portrait Gallery, panel discussions, and teacher workshops in Humboldt, San Diego, Davis, San Francisco, and San Jose will commemorate his work.

The Oakland Museum of California’s celebration will be especially meaningful — Korematsu was born and raised in Oakland.  The event will include remarks from Oakland Mayor Jean Quan, a talk by Karen, performances by students from the Korematsu Discovery Academy in Oakland, vocalist Shirley Kazuyo Muramoto, and koto player Brian Mitsuhiro, and a screening of the Emmy Award-winning Of Civil Wrongs and Rights: the Fred Korematsu Story.

The elder Korematsu was a civil rights hero who refused to be incarcerated in the Japanese internment camps during World War II. When President Roosevelt signed Executive Order 9066 on February 19, 1942 requiring Japanese Americans to be placed in internment camps, the 23-year-old Korematsu refused to report. He attempted to continue his life as a normal American citizen, but was spotted and arrested in San Leandro three months later. Convicted for violating military orders, he lived for several months at the Tanforan assembly center in San Bruno and subsequently was transferred to Topaz, Utah — one of the 10 incarceration camps that were set up for Japanese Americans during WWII — where his family was also being held. 

Korematsu refused to let go of the belief that his civil liberties as guaranteed by the constitution were being directly violated. He appealed his case to the U.S. Supreme Court to no avail. 

That is, until 1983, when researcher Aiko Herzig-Yoshinaga and professor Peter Irons brought to light previously-suppressed documents detailing the FBI and military intelligence agencies’ conclusion that Japanese Americans were not threats to national security. 

Korematsu’s case was re-opened by a legal team of pro bono attorneys and at long last, his conviction was overturned in a federal court in San Francisco. In 2011, the U.S. Department of Justice released an admission of error in the case of the Japanese American internment camp. 

Karen is disappointed that her father didn’t live to see the apology. But she sees the confession as an important step towards bringing “accountability to people in government who need to take responsibility in making sure that decisions are always in the best interests of all Americans.”

She holds that actions like those of her father are especially relevant today, in these times of anti-immigrant sentiment. “He took a stance against racial profiling in issues such as national security and immigration,” she said. 

Following 9/11, Fred, along with the Japanese American Citizen League, spoke out against the national security measures the U.S. government was taking towards Muslim inmates being held at Guantanamo Bay. He became an active member of the National Coalition for Redress and Reparations. He assisted in the passage of a bill that prompted an official apology from the U.S. government, granting $20,000 for each surviving Japanese American who was incarcerated.

Today, Fred’s legacy lives on through the work of the Korematsu Institute. Founded in 2009 through the Asian Law Caucus, the institute’s mission is to advance pan-ethnic civil and human rights through education. 

Karen said that one of the many ventures of the institute is creating supplemental curriculum for K-12 schools to provide historical information that is missing in textbooks. She believes that her father’s story is an important lesson for children. “It tells the truth about American history, the Constitution, and their own backgrounds,” she said. 

Sensitive to the current financial troubles of California’s school system, the Korematsu Institute raises funds independently to create educational kits that it distributes to schools free-of-cost. 

Upon her father’s death, Karen believed that she had been passed on the torch in terms of challenging prejudice through education — so that nothing similar to the Japanese internment camps will ever happen again. “It’s heartwarming to tell my father’s story and see his legacy grow,” she concluded.

How should San Franciscans vote?

The Board of Supervisors Rules Committee will consider competing proposals for changing how elections are conducted in San Francisco tomorrow (Thu/26) at 2 p.m., taking public testimony and voting on which ideas should go before voters in June.

Sups. Sean Elsbernd and Mark Farrell propose to end the ranked-choice voting (RCV) system and go back to runoff elections, while Sups. David Campos and John Avalos propose modifying RCV to allow more than three candidates to be ranked and changing the public campaign financing system to make qualifying more difficult and thus thin the electoral herd a bit. They would also consolidate odd-year elections for citywide offices into a single year, a proposal that Sup. Scott Wiener is also offering as a stand-alone measure.

“We believe our current election system fundamentally works. However, we heard concerns from voters during our last election that it was difficult to discern the different ideas and ideologies of the numerous candidates in the race. We are introducing an ordinance today that is designed to address this concern,” Avalos said in a public statement on Jan. 10 when their measure was introduced.

That package came in reaction to the proposal to repeal the RCV system that voters approved in 2002, a campaign that has been strongly promoted for years by political moderates, downtown groups such as the San Francisco Chamber of Commerce, and the San Francisco Chronicle and other mainstream media outlets.

During a forum at the San Francisco Planning and Urban Research Association last week, Elsbernd debated Steven Hill – the author and activist who created the city’s RCV system – on the issue. Much of it came down to differences over how to gauge the will of voters and allow them to make good decisions.

Hill’s argues that runoff elections – which have traditionally been held in December, although the current proposal could create either June/November or September/November elections – tend to have very low turnout of voters (who tend to be more white, rich, and conservative than in general elections). And they are usually dominated by nasty, corporate-funded independent expenditures campaigns designed to sully the more progressive candidate.

“Let’s face it, December was just a terrible time of year for an election,” Hill said, adding that September would be just as bad, June is too early, and both options would also likely have low turnouts.

Hill said that while RCV may have flaws, so does every electoral system, but that RCV is an accurate gauge of voter preference. He displayed charts and statistics showed that the winning candidate in every election since RCV started has won a majority of the continuing ballots, which are those that remain after a voter’s first three choices have been eliminated.

But Elsbernd seized on that idea to say, “Continuing ballots, that’s what this issue is all about.” He made the distinction between continuing ballots and total ballots cast, saying the latter is what’s important and that few winners under RCV receive a majority of total ballots cast.

“Our elected officials should be elected by a majority of the votes cast,” Elsbernd said.

He said that runoff elections offer voters a clear distinction between different candidates and their ideologies, and he even dangled a proposition that might have appealed to progressives in the last mayor’s race: “Wouldn’t we have loved our month of Ed Lee debating John Avalos about the future of San Francisco?”

Elsbernd cited crowded field free-for-all races like the District 10 race of 2010, in which Malia Cohen came from behind to win using RCV, saying they muddy up the contests. “The benefit of the runoff is you get that true one on one,” Elsbernd said, calling for “real discussion, real debates, about what San Franciscans want.”

Yet Hill said the crowded fields of candidates in some recent races wasn’t caused by RCV, a system that promotes real democracy by giving voters more than one choice of candidates rather than being stuck with the lesser of two evils. And rather than showing the problems with RCV, Hill said Cohen’s election (an African-American woman elected to serve a largely African-American district) and that of Mayor Jean Quan in Oakland (who came from behind to beat Don Perata, who many perceived as a corrupt party boss) show how RCV can help elevate minority and outsider candidates.

All those arguments – and many, many more – will likely be made during what’s expected to be a long afternoon of public testimony.

In the deft routines that follow, as well as in the snapshots cast on the atmospherically dingy curtain hung center stage, the career of this Pickle Family Circus brat (already alone in the spotlight by age two) never veers far from the shadow of his father. That fact remains central to the winning comedy and wistful reflection in Humor Abuse. Reared in the commotion and commitment of the famed San Francisco circus founded by his parents Larry Pisoni and Peggy Snider, Lorenzo had a childhood both enviable and unusually challenging. The fact that he shares his name with both a grandfather and his dad’s famous clown persona is instructive. His trials and his triumphs are further conflated — along with his father’s —in such elegant catastrophes as falling down a long flight of stairs. And in his good-humored and honest reflections, the existential poignancy at the heart of such artful buffoonery begins to rise to the surface. The spoken narrative feels a little pinched or abbreviated, in truth, but there are no shortcuts to the skill or wider perspective inculcated by the charming Pisoni and (under direction of co-creator Erica Schmidt) set enthralling in motion. You hear a lot of lip service these days to “community-building,” even when that community might represent the merest sliver, unable to reach out or expand beyond its own narrow parameters. That is not the kind of community playwright Cherríe Moraga is interested in paying lip service to, and her latest work New Fire reaches out in all possible directions, most notably digging deep into sacred spaces frequently left out of the conversation altogether. Structured not as a conventional (by Western standards) play, but as a healing ceremony centered around the story’s single protagonist, Vero (Dena Martinez), Celia Herrera Rodriguez’ staging and design blend seamlessly with Alleluia Panis’ ecstatic choreography to create a world where the sacred and the mundane coexist, almost unremarked, but certainly remarkably. Combining new media such as video by Emily Encina, with ancient ritual, the most electrifying moments are those rendered wholly without spoken words — the steady heartbeat of percussion, the ululation of Charlene O’Rourke’s magnificent chanting, the stealthy creeping of spirit figures whose faces are hidden by the wide brims of vibrantly painted hats. But don’t go in expecting a woo-woo, earth mother love fest: New Fire, is heavy with dark moments. But as El Caminante (Robert Owens-Greygrass) points out, such darkness can be beautiful too. If the thought of someone as perennially irreverent, insouciant, and appealingly immature as Gomez makes you depressed, the show is, strangely enough, the best antidote. (Avila)

The titular Los Angeles residency hotel was where Reed lived and worked for a time in the 1980s while attending university. It’s also a rich mine of memory and material for this physically protean and charismatic comic actor, who sails through two acts of often hilarious, sometimes touching vignettes loosely structured around his time on the hotel’s young wait staff, which catered to the needs of elderly patrons who might need conversation as much as breakfast. On opening night, the episodic narrative seemed to pass through several endings before settling on one whose tidy moral was delivered with too heavy a hand, but if the piece runs a little long, it’s only the last 20 minutes that noticeably meanders. And even with some awkward bumps along the way, it’s never a dull thing watching Reed work. (Avila)
