“My father is a farmer in Chiapas, and grows corn, mangoes, and bananas. Our land wasn’t enough to support our family, though. The little we were able to grow was just to eat.

“When I was 16 I left home and school, and went to Mexico City. Parents never want their children to leave. But we … can’t stay. The majority of young people in my town have left, like me, looking for a way to help their families survive.

“In Mexico City I found work as a musician, because I play the marimba. Then I met my wife. I was the one who suggested to her that we come here. I came first and found a job with this same agency. After five months, I put together enough money to bring my wife.

“We had a daughter we had to leave behind. She was just 3 when we left, and she’s 16 years old now. This was very hard for us. We send money home for her, but she doesn’t want to come live here and leave her grandmother. We don’t want to force her. And now, of course, it’s much harder to come. It’s not just more expensive, but you’re risking your life.

“When we were thinking about coming here, my idea was that we’d stay here for two or three years, save up some money, and then go back and build a house. Now we’ve been here 14 years, and we can’t go back. My children belong here, and there are a lot of benefits for them here.

“I worked at ACI for 12 years. When I started I was a sorter on the line. Then they asked me if I wanted to operate machinery. I ran the packing machine. My job was to watch the line, and calculate the weight of the material going into the machine. If I let too much go in, the machine would seize up. It would be a big headache.

“No one is irreplaceable, but it takes anyone time to learn. You can’t go to sleep on this machine. If you fall in, you’ll wind up in pieces. This is a very dangerous place to work.

“At another company, a friend of my wife reached in to free a piece of metal that had jammed the machine. The machine grabbed his foot. He didn’t lose it, but he’s disabled now.

“When I started at ACI they paid me $6.75 an hour. I left in 2009 because they were only paying me $8.50. But the person they hired to replace me wasn’t very good at the job. After a year, the agency called me and I went back at $10 an hour.

“I didn’t know about the living wage, but some women at work talked with Agustin from the union and decided to file the suit. I never imagined they would fire us for this.

“I thought if we filed a suit, it might lead to having a union. Instead, [the agency managers] said, ‘We want you to re-verify your Social Security number, and bring us proof that you can continue to work here.’

“If we had good numbers we’d never have the kind of problems we have now. By 2001, when I came, you could not get a real Social Security number, although long ago you could.

“At first I was very angry. I felt helpless. And then quickly I began to worry. I have to pay the rent, the bills. The kids have to eat. When you’re working, you only make enough just to live.

“I haven’t been able to find another job. My wife is working, but only part time. Lately I’ve been going out to work with some friends. But it’s just two or three days a week. Every penny I make I’m putting away to pay the rent.

“I don’t believe that what happened to us at ACI is just. We’re looking for the welfare of our families, trying to get a fair wage so we can live better. People need to understand what happened to us — the abuse and low pay that immigrants have to live with.”

Invisible no more

We all want to be responsible for our environment. We sort our trash. We put the right things into the right containers, and feel good when we see them at the curb on trash pickup day.

Then the trash disappears. End of story.

But really, it’s not the end. Not only does the trash go somewhere, but people still have to sort through what we’ve thrown away. In a society full of people doing work that’s unacknowledged, and often out of sight, those who deal with our recycled trash are some of the most invisible of all.

Sorting trash is dangerous and dirty work. In 2012 two East Bay workers were killed in recycling facilities. With some notable exceptions, putting your hands into fast moving conveyor belts filled with cardboard and cans does not pay well — much less, for instance, than the jobs of the drivers who pick up the containers at the curb. And the sorting is done almost entirely by women of color; in the Bay Area, they are mostly immigrants from Mexico and Central America, as well as some African Americans.

This spring, one group of recycling workers, probably those with the worst conditions of all, finally had enough. Their effort to attain higher wages, particularly after many were fired for their immigration status, began to pull back recycling’s cloak of invisibility. Not only did they become visible activists in a growing movement of East Bay recycling workers, but their protests galvanized public action to stop the firings of undocumented workers.

 

ILLEGAL WAGES FOR “TEMPORARY” WORKERS

Alameda County Industries occupies two big, nondescript buildings at the end of a cul-de-sac in a San Leandro industrial park. Garbage trucks with recycled trash pull in every minute, dumping their fragrant loads gathered on routes in Livermore, Alameda, and San Leandro. These cities contract with ACI to process the trash. In the Bay Area, only one city, Berkeley, picks up its own garbage. All the rest sign contracts with private companies. Even Berkeley contracts recycling to an independent sorter.

At ACI, the company contracts out its own sorting work. A temp agency, Select Staffing, hires and employs the workers on the lines. As at most temp agencies, this means sorters have no health insurance, no vacations, and no holidays. It also means wages are very low, even for recycling. After a small raise two years ago, sorters began earning $8.30 per hour during the day shift, and $8.50 at night.

Last winter, workers discovered this was an illegal wage.

Because ACI has a contract with the city of San Leandro to process its recycling, it is covered by the city’s Living Wage Ordinance, passed in 2007. Under that law, as of July 2013: “Covered businesses are required to pay no less than $14.17 per hour or $12.67 with health benefits valued at least $1.50 per hour, subject to annual CPI [consumer price index] adjustment.”

There is no union for recycling workers at ACI, but last fall some of the women on the lines got a leaflet advertising a health and safety training workshop for recycling workers, put on by Local 6 of the International Longshore and Warehouse Union. There, they met the union’s organizing director, Agustin Ramirez. “Sorting trash is not a clean or easy job anywhere,” he recalls, “but what they described was shocking. And when they told me what they were paid, I knew something was very wrong.”

Ramirez put them in touch with a lawyer. In January, the lawyer sent ACI and Select a letter stating workers’ intention to file suit to reclaim the unpaid wages. ACI has about 70 sorters. At 2,000 work hours per year each, and a potential discrepancy of almost $6 per hour, that adds up to a lot of money in back wages.

The response by ACI and Select was quick. In early February, 18 workers — including all but one who’d signed onto the initial suit — were called into the Select office. They were told the company had been audited by the Immigration and Customs Enforcement agency of the Department of Homeland Security a year before, and that ICE had questioned their immigration status. Unless they could provide a good Social Security number and valid work authorization within a few days, they’d be terminated.

Instead of quietly disappearing, though, about half the sorters walked off the lines on Feb. 27, protesting the impending firings and asking for more time from the company and ICE. Faith leaders and members of Alameda County United for Immigrant Rights joined them in front of the ACI office. Workers came from other recycling facilities. Jack in the Box workers, some of whom were fired after last fall’s fast-food strikes, marched down the cul-de-sac carrying their banner of the East Bay Organizing Committee. Even San Leandro City Councilman Jim Prola showed up.

“The company told us they’d fire anyone who walked out,” said sorter Ignacia Garcia. But after a confrontation at the gate, with trucks full of recycled trash backed up for a block, Select and ACI managers agreed the strikers could return to work the following day. The next week, however, all 18 accused of being undocumented were fired. “Some of us have been there 14 years, so why now?” wondered Garcia.

In the weeks that followed, East Bay churches, which earlier called ICE to try to stop the firings, collected more than $6,500 to pay rent for nine families. According to Rev. Deborah Lee, director of the Interfaith Coalition for Immigrant Rights, “after they had a chance to meet the fired workers and hear their stories, their hearts went out to these hardworking workers and parents, who had no warning, and no safety net.” Money is still coming in, she says.

 

ONE OF MANY BATTLES

Because cities give contracts for recycling services, they indirectly control how much money is available for workers’ wages. But a lot depends on the contractor. San Francisco workers have the gold standard. Recology, whose garbage contract is written into the city charter, has a labor contract with the Teamsters Union. Under it, workers on its recycle lines are guaranteed to earn $21 an hour.

Across the bay, wages are much lower.

ACI is one battle among many taking place among recycling workers concerning low wages. In 1998, Ramirez and the ILWU began organizing sorters. That year 70 workers struck California Waste Solutions, which received a contract for half of Oakland’s recycling in 1992. As at ACI, workers were motivated by a living wage ordinance. At the time, Oakland mandated $8 an hour plus $2.40 for health insurance. Workers were only paid $6, and the city had failed to monitor the company for seven years, until the strike.

Finally, the walkout was settled for increases that eventually brought CWS into compliance. During the conflict, however, it became public (through the Bay Guardian in particular) that Councilman Larry Reid had a financial interest in the business, and that CWS owner David Duong was contributing thousands of dollars in city election races.

Waste Management, Inc., holds the Oakland city garbage contract. While garbage haulers have been Teamster members for decades, when Waste Management took over Oakland’s recycling contract in 1991 it signed an agreement with ILWU Local 6. Here too workers faced immigration raids. In 1998, sorters at Waste Management’s San Leandro facility staged a wildcat work stoppage over safety issues, occupying the company’s lunchroom. Three weeks later immigration agents showed up, audited company records, and eventually deported eight of them. And last year another three workers were fired from Waste Management, accused of not having legal immigration status.

Today Waste Management sorters are paid $12.50 under the ILWU contract — more than ACI, but a long way from the hourly wage Recology pays in San Francisco. Furthermore, the union contracts with both CWS and Waste Management expired almost two years ago. The union hasn’t signed new ones, because workers are tired of the second-class wage standard.

To increase wages, union recycling workers in the East Bay organized a coalition to establish a new standard — not just for wages, but safety and working conditions — called the Campaign for Sustainable Recycling. Two dozen organizations belong to it in addition to the union, including the Sierra Club, the Global Alliance for Incinerator Alternatives, Movement Generation, the Justice and Ecology Project, the East Bay Alliance for a Sustainable Economy, and the Faith Alliance for a Moral Economy.

ILWU researcher Amy Willis points out, “San Francisco, with a $21 wage, charges garbage rates to customers of $34 a month. East Bay recyclers pay half that wage, but East Bay ratepayers still pay $28-30 for garbage, recycling included. So where’s the money going? Not to the workers, clearly.”

Fremont became the test for the campaign’s strategy of forcing cities to mandate wage increases. Last December the Fremont City Council passed a 32-cent rate increase with the condition that its recycler, BLT, agree to provide raises. The union contract there now mandates $14.59 per hour for sorters in 2014, finally reaching $20.94 in 2019. Oakland has followed, requiring wage increases for sorters as part of the new recycling contract that’s currently up for bid.

Good news for those still working. But even for people currently on the job, and certainly for the 18 workers fired at ACI, raising wages only addresses part of the problem. Even more important is the ability to keep working and earn that paycheck.

 

CRIMINALIZING IMMIGRANT WORKERS

When ACI and Select told workers they’d be fired if they couldn’t produce good Social Security numbers and proof of legal immigration status, they were only “obeying the law.” Since 1986, U.S. immigration law has prohibited employers from hiring undocumented workers. Yet according to the Pew Hispanic Trust, 11-12 million people without papers live in the U.S. — and not only do the vast majority of them work, they have to work as a matter of survival. Without papers people can’t collect unemployment benefits, family assistance or almost any other public benefit.

To enforce the law, all job applicants must fill out an I-9 form, provide a Social Security number and show the employer two pieces of ID. Since 1986 immigration authorities have audited the I-9 forms in company personnel records to find workers with bad Social Security numbers or other ID problems. Immigration and Customs Enforcement (ICE) then sends the employer a letter, demanding that it fire those workers.

According to ICE, last year the agency audited over 2,000 employers, and similar numbers in previous years. One of the biggest mass firings took place in San Francisco in 2010, when 475 janitors cleaning office buildings for ABM Industries lost their jobs. Olga Miranda, president of Service Employees Local 87, the city’s janitors union, charges: “You cannot kill a family quicker than by taking away their right to find employment. The I-9 audits, the workplace raids, E-Verify, make workers fear to speak out against injustices, that because of their immigration status they have no standing in this country. They have criminalized immigrants. They have dehumanized them.”

One fired janitor, Teresa Mina, said at the time, “This law is very unjust. We’re doing jobs that are heavy and dirty, to help our children have a better life, or just to eat. Now my children won’t have what they need.”

Similar I-9 audits have taken place in the past two years at the Pacific Steel foundry in Berkeley, at Silicon Valley cafeterias run by Bon Appetit, at South Bay building contractor Albanese Construction, and at the Dobake bakery, where workers prepare food for many Bay Area schools. All are union employers.

Sometimes the audits take place where workers have no union, but are protesting wages and conditions. Like the ACI workers, in 2006 employees at the Woodfin Suites hotel in Emeryville asked their employer to raise their wages to comply with the city’s living wage ordinance. Twenty-one housekeepers were then fired for not having papers. Emeryville finally collected over $100,000 in back pay on their behalf, but the workers were never able to return to their jobs.

Last fall, as fast-food workers around the country were demanding $15 an hour, several were fired at an Oakland Jack in the Box for being undocumented. “They knew that when they hired us,” said Diana Rivera. “I don’t believe working is a crime. What we’re doing is something normal — we’re not hurting anyone.” The Mi Pueblo Mexican market chain also fired many workers in an immigration audit, during a union organizing drive.

Because the audits are not public, no exact total of the number of workers fired is available. ICE spokesperson Virginia Kice would not comment on the audit at ACI. In response to an information request, she stated: “To avoid negatively impacting the reputation of law-abiding businesses, we do not release information or confirm an audit unless the investigation results in a fine or the filing of criminal charges.” Neither ACI nor Select Staffing responded to requests for comment.

San Francisco became a leader in opposing the firings in January, when the Board of Supervisors passed unanimously a resolution calling on the Obama administration to implement a moratorium on the audits and on deportations. Other cities, like Los Angeles, have also opposed deportations, but San Francisco added: “End the firings of undocumented workers by ending the I-9 audits and the use of the E-Verify system.”

Gordon Mar, of Jobs with Justice, urged the board to act at a rally in front of City Hall. “When hundreds of workers are fired from their jobs,” he declared, “the damage is felt far beyond the workers themselves. Many communities have voiced their opposition to these ‘silent raids’ because they hurt everyone. Making it a crime to work drives people into poverty, and drives down workplace standards for all people.” Like many Bay Area progressive immigrant rights activists, Mar calls for repealing the section of immigration law that prohibits the undocumented from working.

The Board of Supervisors urged President Obama to change the way immigration law is enforced, in part because Congress has failed to pass immigration reform that would protect immigrants’ rights. The Senate did pass a bill a year ago, but although it might eventually bring legal status to some of the undocumented, other provisions would increase firings and deportations.

Like the Board of Supervisors, therefore, the California Legislature has also passed measures that took effect Jan. 1, to ameliorate the consequences of workplace immigration enforcement: AB 263, AB 524, and SB 666. Retaliation is now illegal against workers who complain they are owed unpaid wages, or who testify about an employer’s violation of a statute or regulation. Employers can have their business licenses suspended if they threaten to report the immigration status of workers who exercise their rights. Lawyers who do so can be disbarred. And threats to report immigration status can be considered extortion.

It’s too early to know how effective these new measures will be in protecting workers like the 18 who were fired at ACI. While a memorandum of understanding between ICE and the Department of Labor bars audits or other enforcement actions in retaliation for enforcing wage and hour laws, ICE routinely denies it engages in such retaliation.

Yet, as difficult as their situation is, the fired recyclers don’t seem to regret having filed the suit and standing up for their rights. Meanwhile, the actions by the cities of Oakland and Fremont hold out the promise of a better standard of living for those still laboring on the lines.

 

New minimum wage proposal less ambitious, has broader support

San Francisco bears the unfortunate distinction of having the fastest-growing income inequality nationwide. At the same time, the city may retain its more progressive status as having the highest nationwide minimum wage — if voters approve a November ballot measure unveiled today by Mayor Ed Lee and 10 members of the Board of Supervisors.

The consensus measure would increase the minimum wage for all San Francisco employees to $15 an hour by 2018. Currently, the city’s lowest-paid workers earn $10.74 per hour under the existing minimum wage ordinance.

The proposed increase, announced at a June 10 press conference held in Mayor Lee’s office, calls for minimum wage workers to earn $12.25 per hour by May Day of next year, followed by paycheck increases amounting to $13 an hour in 2016, $14 an hour in 2017, and $15 an hour in 2018.

Crafted by representatives from labor, business, and the nonprofit sector in conjunction with Mayor Lee and Sup. Jane Kim, this November ballot measure proposal is less ambitious than an earlier minimum wage increase floated by the Campaign for a Fair Economy, although both guarantee workers an eventual $15 an hour.

The earlier proposal, backed by a coalition that included city employee union SEIU Local 1021, the Progressive Worker’s Alliance, San Francisco Rising, and other progressive organizations, sought to increase the minimum wage to $13 an hour by 2015, $14 by 2016, and $15 by 2017.

So at the end of the day, the newly unveiled consensus proposal would leave minimum wage earners with $0.75 less per hour in 2015 and $1 less in 2017 than what the Campaign for a Fair Economy originally called for, but the broader support for this measure might mean brighter prospects for lowest-paid workers in the long run. The consensus proposal also eliminates the idea of an enforcement committee tasked with holding employers to the mandatory wage increases, yet continues to allocate resources for this purpose.

Shaw San Liu of the Campaign for a Fair Economy, who was part of the negotiations for the consensus measure, noted that this piece was especially important: “It is meaningless to raise the minimum wage if they’re not going to enforce it,” she said. The Office of Labor Standards and Enforcement, tasked with upholding the minimum wage, is currently experiencing a backlog due to case volume.

Moderates’ strong opposition to the more ambitious wage increase posed the threat of having two competing measures going to voters in November. Now that a single unified measure is headed to the ballot, there may be less of a risk that workers will end up with an inadequate increase or none at all.

The across-the-board increase to $15 an hour makes this a stronger proposal than a similar wage increase moving forward in Seattle, although that city has a lower cost of living than San Francisco, so the wage will stretch a lot farther. San Francisco has a notoriously high cost of living; former Mayor Willie Brown once famously quipped that anyone earning less than $50,000 simply shouldn’t try to live in the city, and rents were much lower then. Under this proposal, minimum wage workers can hope to earn $31,200 before taxes by 2018, with wages continuing up from there in correlation with Consumer Price Index adjustments.

The San Francisco Chamber of Commerce was adamantly opposed to the earlier ballot measure proposal, but is now on board. “We think that with consensus built up around this measure, which residents will be voting on, we’ve reached that compromise,” Wade Rose, co-chair of the Public Policy Committee of the SFCOC, said at the press event.

However, the SFCOC played a minimum role in the negotiations, with the key players being labor leader Mike Casey, Liu of the Progressive Workers Alliance, Sup. Kim and her staff, and Mayor Lee and his staff, with input from a variety of minimum wage earners, employers, and other stakeholders.

Kim called the measure “the most progressive and strongest minimum wage proposal in the country,” and later clarified that unlike a similar proposal in Seattle, this measure guarantees a $15 wage across the board regardless of business size or additional benefits. “There will be no tip credit or health care credit – this will be pure wages that San Francisco workers will be bringing home to their families,” Kim said. “Despite setting a successful precedent in 2003, which set the highest minimum wage in the country then, in the last years in particular we’ve been seeing a widening income gap between our lowest paid workers and our highest paid workers. In times of economic prosperity, no one should be left behind.”

“We’ve heard input from all of the different affected sectors of our community – earners, and people who pay the minimum wage, we’ve heard from nonprofits as well as small businesses and large businesses,” Mayor Lee said at a June 10 press conference. “And today, with the current minimum wage at $10.74, there’s been an across the board agreement that that just doesn’t cut it; that’s not enough.”

Lee emphasized that with the unveiling of the consensus proposal, “there are no two measures. There is one measure,” destined for the November ballot. He added that in the course of negotiations between opposing sides, “there was reality that needed to be checked in on all sides.”

Campos wins veto-proof support for closing the city healthcare coverage loophole UPDATED

Sup. David Campos appears to have finally succeeded in his years-long quest to prevent San Francisco employers from pocketing money the city requires them to use for employee health care costs after winning over two key supervisors to secure a veto-proof majority at today’s [Tues/10] Board of Supervisors meeting.

His reform legislation on today’s agenda will be amended by Campos, he told us, to win the support of Sups. Mark Farrell and London Breed. The changes phase out the loophole over three years, making 60 percent of the money in employee health savings accounts off limits to employers next year, 80 percent the following year, and not letting employers reclaim any of these funds by 2017.

“Even if we don’t get to 100 percent right away, once you get past 50 percent it’s a done deal, so I feel good about it,” Campos told us, explaining that even the phased-in legislation will immediately discourage employers from using health savings accounts and to instead put that money toward private insurance or city-run programs such as Healthy San Francisco.

The veto-proof majority is key given that Mayor Ed Lee vetoed similar legislation in 2011, later signing a watered down compromise measure by Board of Supervisors President David Chiu that required employers to maintain the funds for two years before taking them back.

Campos said that reform clearly didn’t work, with that total funding left over in the health savings accounts rising from about $60 million two years ago to about $90 million now. That outcome was predicted by Campos at the time, noting that employers had a disincentive to encourage employees to tap the funds.

“It didn’t work. The numbers showed the money still wasn’t being spent, which is what we said would happen,” Campos told us.

Exacerbating the problem was the fact that the federal Affordable Care Act (aka Obamacare) placed new restrictions on how health savings accounts may be used, fro example banning their use on insurance premiums. Health savings accounts are widely considered far inferior to private insurance at providing quality healthcare, but federal law (ERISA) precluded the city from banning their use by employers to satisfy the city’s health coverage requirement.

Supervisors who haven’t yet committed to supporting Campos’ legislation are Chiu, Scott Wiener, and Katy Tang, but Campos predicted they may sign on now that the measure has a veto-proof majority: “We’re hopeful that with a veto-proof majority, it may be a unanimous vote at the board.”  

UPDATE 6/10: The board unanimously passed the measure on first reading, prompting a sustained standing ovation from the workers and labor advocates who filled the board chambers for the hearing. 

Transportation funding faces key test after Mayor Lee flips on VLF increase UPDATED

Facing a deadline of tomorrow’s [Tues/10] San Francisco Board of Supervisors meeting to introduce measures for the November ballot, advocates for addressing the city’s massive long-term transportation funding gap still hope to introduce an increase in the local vehicle license fee, even though the once-supportive Mayor Ed Lee has gotten cold feet.

While Lee and all 11 of the supervisors support a $500 million general obligation bond that would mostly go toward capital improvements for Muni — a measure almost certain to be approved by its July 22 deadline — the local VLF was originally presented by Lee as a companion measure to fund Muni, street resurfacing, and bike and pedestrian safety improvements.

But when Lee got spooked by a poll in December showing 44 percent voter approval for increasing the VLF and the need to actually do some campaigning for the measure, he withdrew his support and left cycling, streets, and safety all severely underfunded. A report last year by the Mayor’s Transportation Task Force pegged the city’s transportation infrastructure needs at $10.1 billion over 15 years, recommending just $3 billion in new funding to meet that need, including the embattled VLF measure.

“It’s important for us to move forward with the local VLF,” Sup. Scott Wiener, who has taken the lead on ensuring local term transportation funding, told the Guardian. “If this is not the right election, then we have to say which election we will move this forward.”

But so far, Wiener hasn’t gotten a commitment from the Mayor’s Office, with which he says he’s still in active talks. The Mayor’s Office also hasn’t returned Guardian calls on the issue. If Wiener doesn’t get an assurance that the VLF will go before voters, then he says that he’ll push another fall ballot measure that he introduced May 20, which would increase the city General Fund contribution to Muni as the population increases, retroactive to 10 years ago (thus creating an initial increase of more than $20 million annually).

“It would be in lieu of the VLF, not in addition to it,” Wiener said the rival measure, noting that he prefers the local VLF, a stable and equitable funding source that wouldn’t cut into other city priorities. [UPDATE 6/10: Wiener said he received a commitment from Lee to place the VLF increase on the 2016 ballot, so he is dropping his measure to increase Muni funding as the population increases].

Sen. Mark Leno spent about 10 years winning approval for the authorizing state legislation that authorizes San Franciscans to increase the VLF, enduring two governors’ vetoes along the way before getting Gov. Jerry Brown to sign it into law last year.

Wiener notes that the measure would increase the VLF in San Francisco to 2 percent, restoring it its longtime level before Arnold Schwarzenegger used a VLF reduction as a campaign issue to get elected governor, slashing it to 0.65 percent in 2003.

“That action by Gov. Schwarzenegger has deprived California of about $8 billion per year,” Wiener told us. “This is not some newly minted fee, it restores the VLF to what it was going back to the ‘50s.”

San Francisco Bicycle Coalition Director Leah Shahum said she was disappointed that Lee didn’t follow through on his commitment to fund bike and pedestrian safety improvements through the local VLF, but she said there is wide support on the board for the measure.

“Tomorrow is the big day, but we’re hearing real strong support for the measure,” Shahum told us. “I feel strongly there will be eight supervisors committed to introducing the measure.”

That two-thirds vote threshold is part of the legislation that enabled San Francisco to increase its VLF, but Shahum said she believes there is that level of support on the board for doing the VLF increase this year, which the SFBC would actively campaign for.

“The whole idea was these things would go as a package,” Shahum told us. “This is a huge deal for us. Give the voters a chance to vote for safe and smooth streets.”   

Lee’s abandonment of the VLF comes in the wake of his SFMTA appointees’ repeal of Sunday parking meters, which Lee said was driven by a desire to win over car-driving voters for his transportation measures. Last month on Bike to Work Day, Lee and other city officials also touted the measures as important for bike project, although Shahum said the general obligation bond does little for cyclists, except for an allocation for renovating Market Street. 

“There is not a desigination for bike safety and infrastructure, that was goign to be all in the VLF measure,” Shahum said. 

Wiener cited the long road that Leno traveled to give San Franciscans that opportunity as a reason to move forward with increasing the VLF, a progressive tax that charges more for luxury cars than old beaters used by the working class, but Leno was a bit more circumspect about the situation.

“If it taught me anything, it’s patience,” Leno told us about the long road to let San Francisco authorize a higher VLF. “As with anything in the world, timing is everything.”

Leno said support from labor, the business community, and all of City Hall’s top leaders are all necessary to win voter support for increasing the VLF, so it’s crucial that everyone is enthusiastically on board. “I think we may only have one shot, so when we go to the ballot, we need to have our coalition intact.”

Without commenting on the wisdom of delaying the vote this year, Leno said that if that happens, it’s crucial to get everyone to commit to passing it in 2016, a position Wiener also supports.

“There are times when we need to have a long view,” Leno told us. “But one way or the other, we have to get serious about identifying dedicated revenue to invest in Muni or we will all pay a serious price.”

Ethics complaint says chair of DCCC deliberately tried to confuse voters

NOTE: This post has been updated from an earlier version.

Right down to the wire, a complaint filed with the San Francisco Ethics Commission today [Tue/3] – election day – alleges that Democratic County Central Committee elected chair Mary Jung authorized phone calls that were meant to deliberately confuse voters on Proposition B.

The ballot measure, which would require voter approval for waterfront height limit increases, is officially backed by a committee called “No Wall on the Waterfront, Yes on B.”

But according to the Ethics Commission complaint, opponents of Prop. B falsely portrayed No Wall on the Waterfront as being against Prop. B in a bid to confuse voters.

A transcript of the call included in the complaint notes that a live caller opened the communication by saying, “I’m calling about the No Wall on the Waterfront Campaign,” without saying they were calling in opposition to that campaign, and seemingly posing as being affiliated with it. Callers also made statements such as, “Prop B is about environmental loopholes, against affordable housing,” and “No on B endorsements — the Democratic Party, Alice Toklas democratic club, labor.”

“This act by Ms. Jung was a devious and deceptive plan to trick San Francisco voters,” complainant Geraldine Crowley, formerly a DCCC member herself, charged in the filing. “While I realize she employed as a highly paid lobbyist for the San Francisco Association of Realtors – who oppose Prop. B – it crosses the line for Ms. Jung to violate the ethical codes and San Francisco law in this manner.”

We reached Jung by leaving a message on her phone line, listed on the San Francisco Association of Realtors website, next to her job title: “Director of Government and Community Relations.” (Which is really a very convenient arrangement for the real-estate crowd, when you think about it. Who better to relate to the “community” and the “government” than the chair of one of the most politically influential organizations in town, which endorses candidates for elected office?)

When she called us back, Jung confirmed, “We were calling people to vote No on Prop. B.” But what about the allegation that those calls were intentionally deceptive, falsely painting No Wall on the Waterfront as being against Prop. B? “I have not seen the complaint,” Jung told us. She added, “I don’t have a copy of the script” used by callers when they contacted voters. To get a copy of the script, she said, we would have to call political consultant Eric Jaye, who is handling communications for the opposition to Prop. B. We tried calling Jaye but couldn’t reach him.

[UPDATE: Jaye just returned our call. He said Crowley’s complaint is “frivolous” because the callers said they were calling “about” the No Wall on the Waterfront Campaign. “This was what they named their campaign,” Jaye said repeatedly. “It’s not deceptive.” But we asked him multiple times if he would provide a copy of the full call script, and he refused to do so, without offering any reason why he couldn’t.]

What’s more, according to Crowley’s complaint, is that the paid phone calls to DCCC members appear to have originated with venture capitalist Ron Conway, who made a $25,000 donation to the DCCC on May 30. A few days later, Ethics Commission filings show, Jung authorized expenditures totaling $12,281.13 for “membership communication calls.”

Jung denied having had any conversation with Conway about it, and said “the Democratic Party has done a lot of fundraising in the past three months,” and that she could not link a specific donation with a specific DCCC expenditure. She then said she had to go.

Officially, “you can’t give to the party and officially say the donation is for some purpose, but anyone who’s worked in San Francisco politics knows … it’s designed to make something happen,” said Jon Golinger, who heads up the “No Wall on the Waterfront, Yes on B” committee.

He added, “They’re literally using our name to further an agenda that is the opposite” of what the Yes on B campaign has been organizing for.

Some members of the DCCC are reportedly seeking copies of that script, since there seems to have been little awareness of what was being told to voters in the Democratic committee’s name.

But the idea that Jung herself did not know what was being said in the calls, when she authorized the expenditure for membership calls and works in the same office as Prop. B opponents, raises questions about what sort of leadership she’s actually providing.

In the meantime, here’s the Ethics Commission complaint.

Documented, his film with co-director Ann Lupo, chronicles the months before and after Vargas “outed” himself. It’s a highly personal story, especially when the film crew travels to Manila to interview Vargas’ mother. Their geographical separation (she can’t get a visa to see her son in the US, nor can he leave the country to visit her) has become an emotional estrangement so complex she weeps when he refuses to add her on Facebook. But Documented also taps Vargas’ Define American media campaign to broaden its message, interviewing undocumented youths affected by the DREAM Act and sharing in their joy when the bill — providing permanent residency to young, educated immigrants of “good moral character” — finally goes into effect.

Unfortunately for Vargas, who continues to push back in high-profile ways even after he’s declared his status (particularly poignant: scenes at a Mitt Romney rally, where a grandmotherly type asks him, “Why don’t you just become legal?”, as if it’s as simple as buying a car or getting a haircut), he’s too old to benefit from the DREAM legislation. He’s a “walking uncomfortable conversation,” as he calls himself in a lecture excerpted throughout the film; though he feels relief at having come clean, he’s still unable to make any traction in his citizenship quest. At one point, he phones INS (“Deportation. How can I help you?”) to see if anyone’s planning to clamp down, as if finally getting “caught” would be preferable to living in extended limbo. The only closure of sorts comes when Vargas reconnects with his mother via Skype, but there’s an undercurrent of helplessness to their computer-screen reunion that makes Documented‘s themes feel especially raw and urgent.

 

MOUNTAIN VIEWS

Back for its second year, the Himalayan Film Festival unspools over two days, starting Fri/16 in SF with Christoph Schwaiger’s Kamlahari. The rest of the fest, including Kesang Tseten’s Who Will Be a Gurkha, takes place Sat/17 as part of Berkeley’s weekend-long Himalayan Fair.

Kamlahari is a social-justice doc that would be right at home in the Human Rights Watch Film Festival. Filmmaker Schwaiger travels to Nepal’s Teraï region to investigate families that sell their daughters to work in wealthier households, an old tradition that persists despite the fact that child labor is now illegal. The girls are treated cruelly by their “landladies” and are deprived of education and medical care; if and when they’re allowed to return home, their home life may be no less abusive, and their relationships with the family members who pressed them into servitude are strained.

The film’s charismatic center is Urmila Chaudari, a kamlahari from ages six to 17. “My story is one of many stories,” she says, but she’s actually quite extraordinary: After pursuing her education, she became an advocate for girls in Nepal, rescuing them from bondage and working with NGOs to set up safe places for them to live and “find a way back to childhood.” Urmila’s dignified mien and mastery of English makes her an ideal spokesperson, and we follow her as she visits a human-rights conference in Norway and the UN in New York. “It is a first victory for us that everyone is hearing our story,” she says.

Boys in Nepal may be in less danger of becoming household slaves, but their options are also limited. Some dream of joining a special British Army unit, the Brigade of the Gurkhas, established in 1815 and praised for its heroism (and general badassery) in both World Wars. (These days, gurkhas fight in places like Afghanistan, for pay that well exceeds anything offered by the Indian or Nepalese armies.) If the title of Nepalese director Tseten’s film, Who Will be a Gurhka, reminds you of a reality-show competition, that’s not far off, since the film follows the grueling selection (lots of intense physical training, but brain power is also tested) as thousands of wannabes are winnowed to hundreds, then to just under 200.

Gurkha archives provide Tseten with black-and-white footage showing eerily identical selection camps held in decades past, but at just 75 minutes the director misses the chance to go deeper — more history and context, perhaps via interviews with current or retired gurkhas, would add some welcome perspective. Who Will be a Gurkha would also benefit from engaging with, rather than simply observing, its subjects. None of the boys are singled out enough for us to root for them; we learn about their motivations mostly via nervously-blurted answers during interviews with the selection committee, and their personal lives during random conversation snippets, leaving the viewer without focal points amid the film’s sea of hopeful young faces. *

Getting the Kink out

The spotlights shone down, the athletes tussled, and the crowd screamed.

The toned and tattooed female wrestler tackled the topless, tanned, blond wrestler from behind, pulling her down like a tumbling tower. The mat thumped. Cheers erupted. In a sudden reversal, the tanned wrestler gained leverage with her right arm and slammed the tattooed fighter’s shoulders onto the mat, giving the blond the win.

What happened next was definitely not standard wrestling fare.

The tanned wrestler, triumphant, digitally penetrated the tattooed fighter. Her moans silenced the crowd, who listened, rapt. The fight wasn’t sport, but porn, America’s real favorite pasttime. Ultimate Surrender is just one of San Francisco-based studio Kink.com’s 30 or so paid subscription porn websites, including Fucking Machines, Everything Butt, and Hogtied.

But a new series of proposed state laws threatens the state’s porn industry, and the freakiest city on the West Coast may soon say goodbye to its highest profile porn purveyor, Kink.com, which for years has operated out of the historic Armory building on 14th and Mission streets.

The situation raises a question: Is Kink.com breaking up with San Francisco? If legislation requiring condoms on-set in porn and stricter state safety requirements become law, Kink.com CEO Peter Acworth tells the Guardian he has no choice but to leave California entirely.

“We can’t do business under those circumstances,” Acworth told us. “We can’t make a product that can compete.”

The tussle between pornographers, porn actors, and state lawmakers is a crucible where worker safety — and the right to choose how that safety is implemented — may soon be decided. Caught in the crossfire, freaky and sex-positive San Francisco stands to get a whole lot less kinky.

 

ECHOES OF LOS ANGELES

California Assembly Bill 1576 would legally require condom use while shooting porn, mandatory STD testing, and pornographic studios required to hold health records of their talent. The bill cleared the Assembly’s Committee on Labor and Employment just last month, the first step on a short road to gaining the governor’s signature.

Assemblymember Isadore Hall (D-Los Angeles), sponsored the bill, and the day it cleared committee he was triumphant.

“For too long, the adult film industry has thrived on a business model that exploits its workers and puts profit over workplace safety,” Hall said in a press statement. “The fact is, adult film actors are employees, like any other employee for any other business in the state. A minimum level of safety in the workplace should not have to be negotiated.”

The concern is largely over HIV infection on the sets of porn studios, and two parallel statewide efforts are working towards safety on porn sets. The state bill is the first, and the second is the renewed vigor in enforcing longstanding California Division of Occupational Safety and Health regulations.

In the early 1990’s, the federal Occupational Safety and Health Administration adopted a bloodborne pathogens regulation, and DOSH adopted a similar regulation soon after. DOSH’s standard requires employers to take measures to prevent employees’ eyes, skin, and mucous membranes from coming in contact with blood and “other potentially infectious materials,” including semen and vaginal secretions.

To some industries, the standard mandates rubber gloves and goggles. For the porn industry, the DOSH regulations are a moratorium on porn stars ejaculating on each others’ faces, deeming facials a workplace hazard. That standard porn finale can have life-changing ramifications.

“In 2004, there was a big (HIV) outbreak in the industry,” Eugene Murphy, senior safety engineer at DOSH, told the Guardian. “It was demonstrated HIV was clearly contracted on set.”

These infections mostly occurred in Los Angeles, once the center of the porn universe until Measure B arguably changed that. Los Angeles voters mandated porn studio condom use in 2012, and two years later, LA newspapers reported many pornographers have relocated to Las Vegas to escape the regulatory requirements.

The statewide pushback on porn is largely driven by the AIDS Healthcare Foundation, whose President Michael Weinstein has smiled for the cameras alongside Hall and other lawmakers every step of the way.

DOSH began its part in the porn crackdown in Los Angeles, but Murphy was charged with looking into San Francisco’s Kink.com, where Acworth is chafing against the idea of mandatory condoms.

 

RUBBERS REBUFFED

Acworth said he used to believe condoms should be mandatory for performers. After the porn set HIV infections in 2004, Kink.com buckled down.

“I attempted to run the business as condom mandatory for about a year,” Acworth told us. He even pronounced their necessity in an interview on CNN. But there were complications.

“There was pressure from the models themselves because of the chaffing issues,” he said. Porn performers have echoed those sentiments as well.

In an interview with entertainment site Nerve, popular porn star James Deen (see “Dick and smile,” 7/31/12) said he had no problem with personal condom use, but women he’s worked with often complained of chafing.

“I was talking to a girl about it and she was like, ‘Dude, I’m in pain everyday and constantly swollen,'” he told Nerve. “Condoms are intended to be used on an average-sized penis for average sex, and we have entertainment sex, for anywhere from 20 minutes to four hours.”

The condom effort tanked at Kink. Acworth said he withdrew the policy after listening to his performers’ wishes. The studio does adhere to 14-day HIV tests, and condoms are available in a “double-blind” agreement, by which actors can purportedly safely ask for condoms and not fear retaliation.

Despite those efforts, Kink was later awash in condom controversy. Earlier this year, DOSH fined Kink $78,000 in violations connected with the alleged on-stage HIV infections of two actors in 2013, one of whom alleged that a shoot continued despite one actor having a bleeding cut on his penis.

Acworth adamantly asserts the HIV transmission happened in these actors’ personal lives, and says the issue is used as a wedge by the AIDS Healthcare Foundation to push a political agenda. The Guardian attempted to contact the foundation but did not hear back by press time.

Regardless, Murphy said, DOSH is pursuing regulatory requirements around bloodborne pathogens at Kink, and the enforcement of those regulations is not tied to the whether the initial HIV infection case was verified or not.

“My concern,” Murphy said, “is whether there is a healthy and safe workplace.”

 

COMMUNITY TIES

Acworth came to San Francisco for the reasons many do: he wanted a place to be weird, or in his case, kinky.

He wanted a new home from which to shoot his leather porn site, Hogtied.com. New York City was big, but at the time (the ’90s), he felt San Francisco had a more established leather scene in the Folsom Street Fair and leather shops like Mr. S.

“San Francisco,” Acworth said, sitting across from us in a leather bondage chair, “appeared to be more geared up.”

Although not universally loved within the BDSM community, the studio is popular in San Francisco. Part of the credit may go to Kink’s recent revitalization of one of the largest spaces in its 200,000-square-foot historic brick fortress: the Drill Court.

The vast, arch-roofed space was outfitted with modern sound proofing for the benefits of performers and neighbors, but its life as a performance space is not new. In the 1920s, boxers traded blows under its lights, and history may repeat itself, Armor Community Center Sales Manager Quincy Krashna told us.

He’s in talks with Golden Boy Promotions (boxer Oscar De La Hoya’s company) to bring prize fighting back to this historic space. In recent months, the Drill Court played host to a massive New Year’s Eve party, a Game of Thrones-themed dance night and cancer fundraiser, and even an evangelical medical conference, where missionaries offered free dental and doctor checkups to the public.

“The Holy Spirit was truly present at this event,” a doctor from the program, Building Bridges, wrote on the program’s website.

Even bigger changes could be in store. Last month, Acworth filed an application with the city to convert most of the historic Armory into office space, what he called a “last ditch” plan in case the state condom ban passes and Kink decamps for Nevada.

“This move represents an insurance policy,” he told us.

In a public May 11 letter to Weinstein of the AIDS Healthcare Foundation, Acworth asked the foundation for a truce: “I am reaching out to you and AHF, in the hopes of a day where we may sit across the table from one another and agree on common goals and strategy on protecting performers as opposed to continuing this battle.”

As he notes in his letter, if pornographers lose this battle, the companies may relocate. If Acworth finds himself uncomfortably bound and gagged by new regulations, his safe word may be: Nevada.

It seems like San Francisco may surpass itself as the city with the highest minimum wage in the country, as labor activists and business groups are each pitching their own fall ballot measures to raise wages for the lowest paid workers.

The city’s current minimum wage of $10.74 is the highest in the country, but that still isn’t enough, according the labor activists, not in the city with the most expensive rent in the US and one of the largest income gaps.

“We have the highest growing gap between the rich and the poor, and the economic disparity is so high right now,” said José Argüelles of Young Workers United. He said the raising the minimum wage “isn’t the whole solution, but it’s part of it. Folks working full time in San Francisco should be able to afford to live in San Francisco.”

But sometimes even working full time in San Francisco isn’t enough to live here. A 2012 study by the San Francisco Department of Health found that even in the most inexpensive neighborhoods of the city, one would have to work 3.4 full-time minimum wage jobs to afford rent in a two-bedroom market rate apartment. In the priciest neighborhoods, one would have to work up to eight full-time jobs to afford rent.

All of this is occurring at a time when minimum wage debates are taking place across the country. President Obama has suggested raising the federal minimum wage from the current $7.25/hour to $10.10/hour, although Congress has been less receptive. Here in California, the state minimum wage of $8/hour will rise to $9/hour this July, and $10/hour by 2016.

The San Francisco ballot measure favored by labor activists is an initiative to raise the hourly minimum wage to $15 by 2017, with a sliding time frame depending on the size of the business. Proponents of the measure, dubbed the Minimum Wage Act of 2014, are just beginning to collect the necessary 9,702 signatures to qualify for the November ballot, and a recent poll found that 59 percent of likely voters supported the increase, while only 36 percent were opposed.

Business groups are usually the first ones to object to higher wages, but the San Francisco Chamber of Commerce and other small business-leaders are working with Mayor Ed Lee to craft their own, albeit more watered-down, ballot measure to increase pay. Despite their efforts, the $15/hour initiative took them by surprise and they are “outraged,” according to a statement released by the Chamber.

“This initiative is nothing more than a thinly veiled attempt to influence the outcome of the consensus-building process that will begin this week under the leadership of Mayor Ed Lee,” Chamber President Bob Linscheid said in the statement.

But many small businesses actually want to see the minimum wage increased, said John Eller of Alliance of Californians for Community Empowerment, one of the labor groups sponsoring the $15/hour initiative.

“What we heard when we talked to small businesses was that big money is coming in to buy up properties, that prices are getting jacked up, and that they are getting displaced, just like the residents of San Francisco,” Eller said. “But genuine interest in San Francisco, supporting young people, getting people out of poverty, and dealing with displacement were the themes that kept coming up.”

The business community wants to see the higher minimum wage phased in over a longer period of time and supports a more “moderate” wage, although an exact rate has not been decided, according to an email sent by Henry Karnilowicz, president of the San Francisco Council of District Merchants Associations. Other concessions that business leaders ask for include a separate, lower minimum wage for tipped servers and new hires in-training.

Raising the minimum wage “is about being fair and being reasonable,” said Karnilowicz. “It’s not true that small businesses are making a fortune, and I’d hate to see a big Walmart or Target coming into town to take their place.”

But Argüelles says that including special exceptions and a piecemeal law is a step in the wrong direction.

“In the past, San Francisco has led the way [with fair labor laws],” he said. “I think we can set a higher standard than that.”

Opponents to raising the minimum wage often claim that doing so hurts jobs and the economy, but a study from economists at UC Berkeley says otherwise. Unemployment in San Francisco has dropped since the last major minimum wage increase, and businesses absorb the extra labor costs through reduced employee turnover and improved efficiency.

The study also found that affected workers are largely adults and disproportionately women and people of color, two groups for whom the income gap is especially vast.

A measure qualifies for the ballot in one of two ways: either by garnering enough signatures through the initiative process, or being placed on the ballot directly by the mayor or a group of four or more supervisors. As of now, it seems plausible that San Franciscans will have two minimum wage measures to choose from this year, one from signatures and another from Mayor Lee.

On May 7, the Chamber released a press release stating that it’s seeking a single, consensus measure rather than two competing ordinances. Labor activists also hope to see one measure, Argüelles said.

There are no details yet on what Lee’s minimum wage ordinance would look like, if he sponsors one. There’s potential for a compromise between labor activists and business leaders, meaning one ballot measure with wide support. Otherwise, it will likely be one measure pitted against the other.

The deadline for Lee to submit his ordinance to the Department of Elections is June 17.

Mayor Lee faces question on minimum wage

San Francisco Mayor Ed Lee will attend the Board of Supervisors meeting today [Tue/13] to participate in “question time” – that exhilarating moment where the city’s highest-ranking official responds to pre-submitted questions with carefully crafted answers.

Today, Lee faces a question about raising the minimum wage, per District 1 Sup. Eric Mar:

“Mayor Lee, San Francisco is now the city with the fastest-growing gap between rich and poor. Yet, we have not raised our minimum wage in a decade. Washington, D.C., Seattle, and Oakland, among other cities, have recently moved to raise their minimum wage. … Some labor groups in the City have proposed to increase the city’s minimum wage to $15 an hour. … Can you share what level you are currently considering increasing the minimum wage to and how you plan on mitigating impacts on small businesses and non-profits?”

Which makes us wonder, will Lee name an actual dollar amount that he and a group of stakeholders he’s convened are considering increasing the minimum wage to?

Or will he stick to the vague answer he gave radio host Michael Krasny in a recent interview on KQED’s Forum? (“I said I was open to up to $15 an hour,” the mayor said in that interview, “and I didn’t state a number at the beginning.”)

Toyota work methods applied at General Hospital

San Francisco’s Department of Public Health has a $1.3 million contract with Seattle-based Rona Consulting Group to implement the Toyota Management System, a workflow methodology based on the auto-manufacturing model, at San Francisco General Hospital.

This new model, which aims for greater workflow efficiency, is being implemented just as healthcare staffers raise concerns that staffing levels at SFGH are dangerously low.

“Nurses often work through their breaks, and they stay after their shifts to get charting done,” said David Fleming, a registered nurse who has been at SFGH for 25 years. “I think nurses are getting the job done – but they’re at the edge.”

A group of healthcare workers spoke out at the May 7 Budget & Finance Committee meeting, during which supervisors discussed the DPH budget. Public employee union SEIU 1021, which represents healthcare workers, is in the midst of contract negotiations but Fleming said they had been grappling with reduced staffing for awhile.

According to a contract request to the Health Commission sent anonymously to the Bay Guardian, DPH entered into a 24-month contract with Rona totaling just over $1.3 million, for the purpose of implementing the Toyota Management System methodology as part of the transition to the new SFGH acute care facility, scheduled to open in December 2015.

The Bay Guardian received a copy of the contract request via BayLeaks, which uses encryption software known as SecureDrop to enable sources to anonymously submit documents.

The $1.3 million came from “General Funds (Rebuild Funds)”, according to the contract request. In 2008, voters approved Prop. A, funding the $887.4 million General Hospital rebuild through general obligation bonds. Use of the voter-approved, taxpayer-supported funds is restricted to hospital construction under a state law that limits the use of bond money to specified purposes.

However, Iman Nazeeri-Simmons, chief operating officer at DPH, said funding for the Rona contract came from a “hospital rebuild transition budget,” which she said provides for needs beyond construction costs.

Specialized consulting to educate hospital staff in the ways of the Toyota Management System doesn’t come cheap. A single meeting between the consultant and “key leaders” to “discuss needs and develop operational project plans” cost $25,225, the document showed. A one-day “visioning session” facilitated by the contractor was priced at $16,814. Five-day workshops fetch Rona $42,032 each. Based on estimates included in the contract request, the consulting firm would earn the equivalent of $4,707 per day.

The $1.3 million consulting contract was awarded even as unions remind city officials of staffing cuts during the economic downturn in 2008 that still have not been restored.

Here’s some video testimony from hospital staffer Heather Bollinger regarding how tough things can get at the General Hospital’s trauma center. “We do have staffing issues, and they do affect patient safety,” she said in public comment to the Health Commission on April 15.

Nato Green, who is representing nurses as a negotiator on behalf of public employee union SEIU 1021, described the staffing levels at SFGH as “unsafe and unsustainable.” There are currently 90 vacancies for nurses that haven’t been filled, he said. That’s a 14 percent vacancy rate, Green noted — typically substituted with traveling nurses, temps, and overtime labor.

Nazeeri-Simmons said the consulting was necessary for the transition to the new SFGH facility, for “doing it in the best way, and understanding there’s a completely different physical environment over there.” Rona is a pioneer in healthcare performance improvement, she said, and they are “leading us in very interactive workflow designs that are simulation-based,” geared toward “maximizing value and driving out waste.”

But does “driving out waste” translate to staffing cuts? “It certainly hasn’t happened here,” Nazeeri-Simmons responded when asked about that. Instead, the consultants have helped management to “right-size services to meet the demand,” she said, noting that wait times in urgent care had been significantly reduced as a result. Decisions such as using a portable X-Ray machine that eliminated the need for patients to walk ten minutes across the hospital grounds had dramatically reduced wait times, she added.

“We need to make sure the staff are working to the highest of their capability,” she added.

Heidi Gehris-Butenschoen, a spokesperson for Rona, said the goal of transforming work practices under the Toyota Management System is to improve patient care. Asked whether the consulting tends to affect staffing levels, Gehris-Butenschoen said, “That’s really up to the hospital. It’s definitely in our workshop not something we focus on. The Toyota system is not about cutting heads at all.”

SFGH has been working with Rona since July 2012. One of the company partners was formerly the CEO of Productivity, Inc., which advised “large-scale transformations for Fortune 100 companies,” according to the contract request. The workflow methodology is rooted in Lean principles, integrating a “just in time” staffing concept that’s been applied in corporate settings such as Walmart.

The Health Commission approved the $1.3 million contract at its Dec. 17, 2013 meeting as part of the consent calendar, which is summarily approved by a single vote.

Fleming, the RN, was skeptical of how much the Lean system had actually accomplished. They had literally “rearranged the furniture” since the program was implemented, he said, and observers had silently monitored staffers’ activities.

“When we work with anyone, we go out to the gemba, and we observe,” Rona’s Gehris-Butenschoen explained, noting that gemba refers to “the place where work happens.” The observations help hospitals identify where waste can be reduced, she added, such as moving a supply cabinet if time is being taken up by crossing the room to get to it.

But Fleming said he wasn’t convinced that applying a corporate efficiency method, borrowed from manufacturing, would provide the greatest benefit in a healthcare setting.

“We are not taking care of cars on an assembly line,” he said. “When it comes to another human being’s body, I don’t know that faster is necessarily better.”
