Should Antonini recuse himself from Lennar vote?

As a Newsom appointee, Planning Commissioner Michael Antonini is expected to be a key vote today in favor of Lennar’s massive redevelopment plan at Candlestick Point-Hunters Point Shipyard.

And then there’s the fact that he wrote an op-ed for the San Francisco Business Times in December 18, 2009, suggesting that business, civic, labor and government leaders can keep the 49ers in town by “joining forces to assist in needed repairs and improvements to Candlestick Park and to expedite development of the Candlestick Point Hunters Point Shipyard, a project that features a “state-of-the art,” 69,000-seat football stadium.”

But Antonini’s cheerleading has got some folks questioning his impartiality when it comes to the decisions that members of the Planning and Redevelopment Commissions will make today around certifying the project’s Final Environmental Impact Report (FEIR) and adopting related environmental findings.

In a June 2 letter to Planning Commission president Ron Miguel, Arthur Feinstein of the Sierra Club, Mike Lynes of the Golden Gate Audubon Society, Jennifer Clary of San Francisco Tomorrow and Jaron Browne of POWER (People Organized to Win Employment Rights) claim that “Commissioner Antonini has clearly prejudged the proposed project and become a strong advocate for locating a football stadium for the 49ers at the Hunters Point site as part of this project.”

“He has publicly urged others to support that stadium and cannot impartially review the record before him to determine whether the EIR is adequate, accurate and objective and whether adequate measures are required to protect the environment,” the foursome continue.

 Noting that he could have chosen to sign the December 2009 op-ed as a Member of the Republican County Central Committee, Feinstein, Lynes, Clary and Browne observe that Antonini “ instead identified himself in the capacity where the law requires him to act impartially – as a Planning Commissioner.”

With others arguing that Antonini’s right to express his opinion is protected by the First Amendment, and Antonini planning to read a rebuttal into the record at 1 p.m. today, it sounds like there’ll be plenty of drama at today’s hearing.

Business leaders can save the Niners

“The 49ers are deeply and historically identified with San Francisco. San Franciscans Vic and Tony Morabito founded the team in 1946, many years before the Giants moved from New York and the Warriors from Philadelphia.

Hence business, civic, labor and government leaders are joining forces to assist in needed repairs and improvements to Candlestick Park and to expedite development of the Candlestick Point Hunters Point Shipyard, a project that features a “state-of-the art,” 69,000-seat football stadium. Leaders from the Committee on Jobs, the San Francisco Chamber of Commerce, Recreation and Park and others are asking businesses and individuals to help with funding of improvements at Candlestick in return for advertising. These improvements could translate into increased revenue for the contributor, the city and the team. Replacement of aging seats and a highly visible new luxury section are two concepts being studied.

Naming rights to Candlestick Park is an attractive opportunity for a company or an entity to gain nationwide exposure and local acclaim — and, perhaps, position itself to be a key contributor when a new stadium is built at Hunters Point. No new stadium can be built anywhere without significant private investment, in addition to $100 million assured from Lennar Corp. as a precondition of development rights and the amount which the 49ers ownership would invest.

On Thursday, Dec. 17, the San Francisco Planning Commission was to hear comment on the Draft Environmental Impact Report for the Candlestick Point Hunters Point Shipyard Plan. Because this plan features many diverse uses, particularly huge amounts of housing, funding is being rapidly obtained for greatly improved transit and traffic access.

San Francisco must avoid the errors of the past, when we failed to build an arena for indoor sporting, major conventions and entertainment events. Such a facility could have brought huge amounts of revenue to San Francisco businesses.

Leaders have twice stepped up to save the San Francisco Giants. One would expect no less from our leaders when dealing with our home grown, five- time Super Bowl champion San Francisco 49ers!

Political juggernaut

City officials are scrambling to secure final approvals to allow Lennar Corp. to move forward with its 770-acre Candlestick/Hunters Point Shipyard redevelopment of San Francisco’s impoverished and polluted southeast sector. But the community remains divided on the project, raising concerns that wary residents will end up being steamrolled by this politically powerful juggernaut.

Some groups say the project needs major amendments, but fear it will be rushed to the finish for political reasons. Others say they are hungry to work and desperate to move into better housing units, so they don’t want all the myriad project details to slow that progress. And Mayor Gavin Newsom’s administration is arguing that approving the project’s final environmental impact report by June 3 is crucial if San Francisco wants to keep the San Francisco 49ers in town.

But many observers fear Lennar wants its entitlements now before its project can be subjected to greater scrutiny that could come with the November elections. Newsom, who made Lennar’s project the centerpiece of his housing policy, will be replaced as mayor if he wins the lieutenant governor’s race. And a crowded field of candidates, many of them progressives concerned about the project’s impacts on the poor and the environment, are vying to replace termed-out Sup. Sophie Maxwell, whose district includes Lennar’s massive territory.

“It’s 180 percent about the 49ers,” land use attorney Sue Hestor told the Guardian, referring to the city’s proposed rush job, as evidenced by a rapid entitlement schedule that the Newsom’s administration wants city commissions and the board to follow.

Under that schedule, which Hestor procured from the Mayor’s Office, Planning and Redevelopment commissioners are expected to certify the project’s final 6,000-page EIR, adopt California Environmental Quality Act findings, approve amendments to the project’s original disposition and development agreement, and authorize land trust and open space reconfigurations — all during a June 3 meeting where public comment will likely last for many hours.

Saul Bloom, executive director of Arc Ecology, a community-based nonprofit that tracks the development, says this schedule stretches the credulity that this is a deliberative process. “There’s no way anyone could make a functional reasoned assessment,” Bloom told us. “How do you have any meaningful public conversation under those circumstances?”

Michael Cohen, Newsom’s chief economic advisor, asserted in an April 29 article in The New York Times that Lennar’s plan is a “really, really good project,” echoing the glowing praise he’s heaped on the project since its conception.

“But there’s nothing new in their proposal,” Bloom told us. “That’s because they haven’t been listening to the public’s concerns. [Cohen] says, ‘Haven’t we talked enough? The community’s been waiting all these years!’ But waiting to get what done?”

Lennar’s project — which had early backing from Newsom, U.S. Sen. Dianne Feinstein, and other political power brokers — was sold as creating “jobs, housing, and parks” and “revitalizing the abandoned shipyard” when voters approved the Lennar-financed Proposition G in 2008.

“Proposition G is from the community and for the community,” Lennar’s campaign promised. “You can turn the abandoned Hunters Point Shipyard into a clean, healthy, sustainable, livable neighborhood — a place where people can raise their children.”

The shipyard once employed thousands of workers, including African Americans who were recruited from the South in the 1940s and ’50s. But the district’s economic engine fell into disrepair when the military left in 1974. Today the neighboring Hunters Point and Bayview neighborhoods have the highest unemployment and crime rates and the largest concentration of African American families in the city.

But the city’s final EIR for the project, which the Planning Department released mid-May, shows that 68 percent of the developer’s proposed 10,500 new housing units will be sold at market rates unaffordable to area residents, and that many of these units will be built on state park land at Candlestick Point.

Lennar is also proposing to build a bridge across the environmentally sensitive Yosemite Slough, significantly changing the southeast waterfront. Lennar says it plans to develop the project’s remaining 3,000 units at below market prices, including one-for-one replacement of rundown Alice Griffith public housing units. Its proposal includes a dozen high-rise towers, 2.7 million square feet of commercial space, 1 million square feet of retail space, a performing arts theater, and an artists colony.

Lennar claims its proposal will create 1,500 construction jobs annually during the project’s 20-year build-out, along with 10,000 permanent jobs, thanks to a United Nations Global Compact Sustainability Center and a vaguely defined green technology office park.

The project and its impacts are already an issue in this year’s District 10 supervisor’s race (see “The battle for the forgotten district,” Feb. 23). Candidate Chris Jackson says Lennar’s proposal is weak when it comes to creating well-paying, low-skilled green collar jobs. He supports Arc’s proposal to including green maritime industrial use at the shipyard.

Arc recommends that the city’s final EIR allow recycling and repairing of ships, including the Suisun Bay Ghost fleet — decommissioned U.S. Navy, cruise, and ferry ships — arguing that “ship recycling and repair are resurgent strategic industrial activities yielding employment opportunities for our existing pool of skilled and unskilled workers.”

Jackson, who was elected to the Community College Board in 2008 and recently jumped into the District 10 race, wants the city to assert that the project is not a regional housing plan.

“It’s a local housing plan for local residents,” Jackson asserts. “It’s not here to provide housing for Silicon Valley. It’s for Bayview-Hunters Point and District 10 residents.”

Jackson understands why some local residents want no delays on final EIR approval: “I can never blame folks in Alice Griffith public housing for coming out and saying ‘no delays.’ They really want something real, housing that is not rat and cockroach infested.”

As a policy analyst (a position he’s quitting to focus on the District 10 race) for the San Francisco Labor Council — which gave key backing to the project in the 2008 election — Jackson knows labor is frustrated by all the project meetings. “I try to tell them it’s better to get this project right than rush it through and find out later that it goes against the interests of labor,” Jackson said.

In May 2008, the Labor Council signed a community benefits agreement (CBA) with Lennar. Since then labor leaders have urged no delays on the project’s draft EIR review. But Jackson believes the city must demand that financial consequences, such as liquidated damages, be a project approval condition if the developer reneges on the CBA.

“Right now the only push-back the city has is to threaten to kill the whole project if Lennar doesn’t meet its timeline,” Jackson said. “But people are really invested in this project, and I don’t believe anyone would pull the trigger and end the entire development. We don’t need to throw everything out; we just need to change them.”

Jackson wants to see the inclusion of a special-use district that would create a cooperative land trust to ensure affordability and home ownership opportunities for local residents. “I love open space and sustainability, but I also want affordable housing and real light-industrial opportunities that can employ people living in the district now.”

Special-use districts, Jackson argues, give city commissioners a way to amend this project to make it more acceptable.

Jackson wants to see strong tenant protections for public housing residents. “The vast majority of those residents are African American. At the end of the day, I want to see economic and environmental justice, so we can say we brought the right change to our community.”

Jackson also would like to see a more independent Mayor’s Office. “Don’t you feel like its 2002/2003, and that if you speak out against the project, it’s like you are speaking out against the Iraq war, and all of a sudden you are not patriotic?”

Fellow District 10 candidate Eric Smith concurred. “The powers that be are definitely moving this thing forward,” he said. “And this is a monster train, a juggernaut that is gathering steam. But how it shakes out down the road remains to be seen. My whole mantra is that there needs to be greater transparency down the line. If I become the sheriff, I’ll be shining a light on all this stuff.”

Smith warned that the community needs to work together or it won’t win a better deal. “It’s clear that folks in the city are hoping against all odds that Lennar can pull this stuff off so they can prove all the naysayers wrong and these community benefits can be realized, and that scrutiny of the projects can go on while all this happens,” he said.

But Arthur Feinstein, the Sierra Club’s political chair, worries that the city’s rush job is resulting in seriously flawed documents and decision-making. “It’s difficult for folks to digest 6,000 pages of comments and responses on the draft EIR in the three weeks since planning posted them online,” Feinstein said. “And nothing has changed despite all the comments, which is why it continues to be a nonsense process.”

Feinstein says the Sierra Club’s top concerns are the Parcel E-2 cleanup on the shipyard, a deal to transfer 23 acres at Candlestick Park for development, and the bridge over Yosemite Slough.

“You can cover most of the site,” he said. “But when it comes to Parcel E-2, where the dump burned for six months in 2002, that’s only 20 acres, it could and should be removed. This is the environmental justice issue that has the community up in arms.”

Feinstein worries about the precedent that selling a state park for condos sets. “This is our park, and they are shrinking it.” He is also concerned that the developer wants to bridge Yosemite Slough for cars.

How many of these concerns will be addressed at the June 3 hearing, which is just days before Santa Clara County voters decide whether to try to lure away the 49ers with a new publicly financed stadium? We’ll see.

“Beach, fun, drinks, girls, and a good time”: Chico Trujillo is your Memorial hangover cure

Thank you holiday weekend, you have memorialized whatever brain cells and desire to integrate into the everyday world of not being drunk by 2 p.m. I still had left. I suppose it was a fair trade for all the lovely memories that I of course won’t remember. Shall we turn then, to something fun that’s happening this upcoming weekend (Fri/4 La Peña Cultural Center) to keep us going? A lovely South American cumbia party that goes by the name of Chico Trujillo? Hurry, before sobriety catches you, cue the mp3 and hold on for the interview!

Now that the tunes are swirling through those alcohol and sunshine wasted synapses — a note of historical significance. For those who have never ratcheted their hips to a sensual beat on a cobblestone colonial street, cumbia originated in the wilds of Colombia. It was originally played for courtship rituals by the area’s enslaved African population. Throughout the years, cumbia’s rolling stone gathered snippets of the culture around it, rhythms from the indigenous Colombians, the use of European instruments, etc, etc. Let’s just say it was adept at bringing people together to party.

Chico Trujillo (who are good old chicos from Chile), inherited this mish-mash legacy, and saw it the addition of ska — a fact which imparts an evident swagger to their most recent release, Chico de Oro. Although on the whole, Chilean cumbia’s been ceding its popularity to the ear drum exploding beats of reggaeton, Chico Trujillo’s gigs still get crazy and light roofs on fire, I guess symbolically speaking. 

Heartened by how cool it’s proven itself to be in the homeland, Chico’s now taking its show to Gringolandia — they’ll be rocking the stage at La Peña Cultural Center as part of that East Bay progressive organization’s 35th anniversary party. I chatted with the band recently via email, and their responses, I guarantee, will make that first day back on your grind a little smoother to jibe with.

 

San Francisco Bay Guardian: I’ve heard that most of your shows in Chile sell out. They sound like amazing parties. What makes a good party, in your opinion? 

Chico Trujillo: In Chile, a good party means the best loud music, best drinks, nicest women (and men, I guess), and everybody dancing and singing. But I think that is a good party anywhere. And yes, all of our shows sell out.

 

SFBG: Oh my. What makes cumbia so awesome?

CT: Its simplicity, and its hypnotizing effect on the people. Once we start, the people just can’t stop, and neither can we.

 

SFBG: Tell us about the social issues you touch on in your music. Do you consider yourselves activists?

CT: As human beings, we consider ourselves activists, and are very concerned with social issues happening in Chile. Although we may not always agree with the “left” all the time (and almost never with the “right”), we do actively participate in events that we feel are important. [There’s] a lot of things concerning the environment in Chile, the native people’s rights there, etc. We just arrived in the US, and have seen non-stop on the TV things about the oil spill.  We would love to do something, anything to help that out. But as for our lyrics, and the music of Chico Trujillo, well, they speak more to the utopian ideals that we have of beach, fun, drinks, girls, and a good time, a break from the real world – [which is] the only things people should think about when we hit the stage. If everyone lived by the lyrics of Chico Trujillo, the world would be a better place…

East Oakland’s peaceful Youth Uprising

Six months ago, Javae Reed could hardly have pictured himself as part of the solution to the problems that plague the East Oakland community where he grew up. Fresh off an incarceration in Reno (Reed had relocated temporarily to be with his mom) on charges of robbery, the 19 year old didn’t have a history of positive association with the system. But thanks to Youth Uprising, a youth advocacy non-profit — which celebrates its fifth anniversary with a gala fundraiser Tues/25 — Javae has landed a job, and got his driver’s license. Not to mention the fact that he’s performing policy work that will make a real difference for other young people like himself.

“I always had this potential in me,” Reed told me over the phone as he sat alongside YU director of strategy and investment director Maya Dillard-Smith. “I just needed that guidance to find it.” After hearing of  Youth Uprising through a friend upon his return to Oakland, Reed went to check out the program. The next day, he found himself heading out for a Youth Uprising LeaderShift retreat with 29 other young men, a trip which focuses on teaching individuals who are already leaders among their peers how to use their charisma and intelligence in a constructive direction.

Reed, a naturally outgoing guy, immediately found his niche. “By the second day, everybody was social, I got comfortable, the staff showed me support, we had fun. I became a part of the YU family,” he recalls. 

It’s indicative of the community-driven nature of YU that Reed was able to connect so readily. The organization celebrates a multi-pronged approach to youth empowerment, focusing both on physical (they operate the most used health clinic in Alameda County) and interior needs (a full purpose media lab gives participants a chance to use their voices artistically, and YU sponsors dance, theater and fine arts programs).

Reed was chosen to become a workshop facilitator, and the organization got to work helping him overcome the obstacles to employment for a young black man in Oakland. Through the Mayor’s Summer Jobs Program, they placed him as a janitor, enrolled him in a computing class to further develop his potential.

And then he was tapped to play a larger role. East Oakland is one of the 14 neighborhoods Building Health and Communities, California’s largest health care foundation, has chosen as a major aide recipient through 2020. Research was needed, however, to identify just how that money was to be allocated.

Who better than the area’s youth themselves to figure that out? Youth Uprising, the lead agency on the project, put Reed and a team of his peers in charge. They were tapped to draw up a survey for their neighborhood that touched on health and safety issues, then gathered responses, and presented their findings to BHC stakeholders (perhaps not surprisingly, national health care reform topped the list of concerns they uncovered). Their conclusions would drive $10 million in social investments.

It was an empowering experience. “You know these things are right, but you’ve never walked in my shoes,” Reed tells me. Although he’d never located himself in politics before, he can now say confidently “I speak for myself — and my generation.”

Reed’s lightening quick transition from disenfranchised youth to community leader is just the kind of change that Youth Uprising wants to keep on the country’s to-do list. “Some people believe the investment should be on the back end with incarceration,” says Dillard-Smith. “But we’re building up social enterprises.”

Which hasn’t been easy in an era of social service mass murder — but YU is pulling through. “We’ve got to have a diversified funding strategy, because the needs of this community are not going away when the funding does,” Dillard-Smith says.

YU’s developing ways to get businesses involved in a way that touches more than just the youth they served. They’ve teamed up with Silicon Valley corporations to keep their data entry programs from being outsourced overseas. “The young people we work with are incredibly computer literate, even when they can‘t read and write,” says Dillard-Smith. They’ve set up their own youth run Corners Café, which gives chosen program participants a chance to develop job skills in a real life environment, and is set to cater your next event.

With all this self made empowerment, it should be no surprise that YU was lauded by US attorney general Eric Holder as a “perfect example” of how change can happen in our beleaguered country. The Mitchell sister

Porn heiress Meta Jane Mitchell Johnson is running a little late when I arrive at the Mitchell Brothers O’Farrell Theater, the adult entertainment establishment her father Jim Mitchell and uncle Artie Mitchell founded on the edge of the Tenderloin, just blocks from City Hall, July 4, 1969.

Johnson, 32, recently became co-owner of the theater and invited me over to discuss her vision for this notoriously hardcore strip club and the challenges she faces in an industry dominated by the Déjà Vu corporate strip club chain, in a town whose political leaders are still trying to figure out how best to regulate the clubs to ensure that their predominantly female workforce is properly compensated and protected from harassment in safe, sanitary conditions.

A young guy on the front register ushers me into a side room. The walls are decorated with photographs that recall the people and players who have made this club such a storied San Francisco institution and a landmark in the history of the sex industry.

There’s an image of a topless Marilyn Chambers, the star of Behind the Green Door, the porn film the Mitchell brothers shot and screened at the theater in 1972 and was a major hit after it became known that Chambers was also the wholesome face on Ivory Snow soap flakes box.

There is a photo of Artie with a young raven perched over his shoulder. It was taken in 1990 during a trip to Aspen, Colo., to support gonzo journalist Hunter S. Thompson, who worked at the club in the 1980s and was facing serious charges, including sexual assault and possession of drugs and explosives, that eventually got dropped.

Another shows both the Mitchell brothers, photographed when they were still young and rakish and battling the vice squad, even as they entertained the local political elite.

Today the brothers are dead, Artie from bullet wounds inflicted when Jim shot him with a rifle in February 1991; Jim from a heart attack in July 2007. And now Jim’s oldest son, James Mitchell, 28, is in jail awaiting trial for allegedly beating his ex-girlfriend Danielle Keller to death with a baseball bat in July 2009 and abducting their baby daughter, Samantha.

Unlike his father, who continued to run the Mitchell porn empire after serving less than three years for voluntary manslaughter, James is facing life behind bars.

“He is charged with six serious felonies and is facing life imprisonment with no possibility of parole,” Marin County Deputy Chief District Attorney Barry Borden said recently. Johnson told me that her brother no longer owns stock in Cinema 7, the corporation the Mitchell brothers founded to oversee their burgeoning sex business.

This latest family tragedy occurred in the wake of a $3.74 million class action suit that was settled in 2008. Brought by three MBOT dancers, the suit led to valid claims by 370 dancers who complained about Cinema 7’s “piece-rate” wage system. Under that system, the club compensated dancers solely for the number of private dances performed, waived meal and rest periods, and failed to reimburse dancers for costumes, props, and makeup.

Since then the club ended the piece-rate system, but introduced chips customers must buy to procure lap dances and encounters in small, curtained private rooms. On a recent night, the girls at the O’Farrell Theater remained smiling and bright-eyed as they succeeded in getting some customers to purchase chips for lap dances and private encounters. But the rest of the crowd remained largely silent and mostly tight-fisted as customers watched the club’s exotic dancers perform on its disco-balled stage.

All of which left me wondering if Johnson can succeed in overcoming her family history and reputation to make a difference for her workers and community while facing a nationwide recession in an industry dominated by an out-of-state chain.

 

THE UNLIKELY SAVIOR

Johnson greets me dressed in Ugg boots and jeans, apologizes for being tardy, and leads the way upstairs to the theater’s office so we can talk.

I first met Johnson in 2007 (“Behind the Mitchell’s Door,” 07/22/09) when she arrived at the theater in knee-high boots, clutching a massive lime handbag and a tiny dog named Baby. During that first encounter, three months after her father died, Johnson confided that when she took over the office, it was full of dildos dancers had given the Mitchell brothers. Placing her dog on the pool table that dominated the office, she said she planned to massage all this male energy toward femininity.

Today it looks as if she has started to deliver on that promise. The pool table is gone. The sofa where Hunter S. Thompson used to sit remains in the room. But now a clothesline runs between the office walls, draped with a stripper’s glove, stilettos, and a G-string emblazoned with the word “Gonzo,” presumably in honor of Thompson.

“It was a little thing we made to give away,” Johnson laughs.

She introduces her youngest brother and club co-owner, Justin. “Me and Justin are close. We are the owners and we are making some changes,” Johnson explains. “We are making the prices more reasonable so customers don’t have to spend an arm and a leg just to get a lap dance. And we’re going to hold events like poetry slams. We are trying to make the club fun again. We definitely see a hit due to the economy, but we’ve also been hit by the decision from the class action lawsuit.”

Johnson insists she and her brother aren’t “your typical strip club owners.”

Were in a symbiotic relationship with our dancers, she says. That sets us apart from other clubs. The dancers are our employees. We pay them minimum wage and workers comp. We cover their Healthy San Francisco costs. We incur a lot of expenses legally employing our dancers. But instead of crying about our handicap,’ she said, referring to treating dancers as employees, my goal is to show we can manage the club without a pimp mentality, without a How much can you shake them down for? approach.

“A lot of our employees have been here a long time and have had to deal with all the painful violent stuff too,” she continued. “And folks are still here, even though their hours got cut and they are not making as much money.

In 2007, Johnson told me that she resented the family business when she was growing up. “The boys could go inside, and I couldn’t,” she recalled. It wasn’t until 2004, when she was working as a mortgage consultant in a cubical farm in San Ramon that Johnson began to take pride in the business “as something that had taken care of us through the years.”

Johnson, who became the club’s scheduling manager in 2005, recalls the shock of losing her dad in 2007. “It was like being dumped in icy water,” she says. “At first we didn’t know how to handle it. But we learned. Five years ago, I was much more liable to listen to advice. But I need to be able to fall asleep feeling good. That involves treating people a certain way. I don’t think any other strip club in the country is being run the way this one is.”

Johnson got married and went on maternity leave in 2008. ” When my son was six months old, I came back for the club’s 40th anniversary party and I realized, they need me both of us [she and her brother]— as owners, steering the proverbial ship. No one else wants to be held accountable. We never discussed selling. Our father built this place. It’s completely shaped our lives. Good or bad, it’s ours.”

 

TOUGH INDUSTRY

As a nude strip club, Mitchell Brothers’ O’Farrell Theatre stands in direct competition with Crazy Horse on Market Street and the Déjà Vu-owned clubs including the Market Street Theaters, Gold Clubs and other spots in SoMa, and most of the clubs in North Beach. The exception is Lusty Lady, the only unionized, worker-owned peepshow in the country.

If you walk into the Gold Club in San Francisco, well, there are 50 other Gold Clubs in the country, so, its generic, Johnson says. But theyve got their business model. Were not trying to copy Déjà Vu or Crazy Horse. Were the Mitchell Brothers. Its been part of us and our whole history.

Dancers agree that the Lusty Lady isn’t in competition with Déjà Vu.

“They’re Walmart, and we’re the mom and pop store on the corner,” Lorelei*, a dancer at Lusty Lady, said. “At the Lusty, we pride ourselves on being alternative and having tattoos and piercings.”

Some dancers, who we’ve indicated with an asterisk after their altered names, voiced fear of being identified as critics of Déjà Vu’s business model.

“If Deja Vu found out I was shit-talking them I would probably get fired and be blacklisted from all their clubs,” Sugar* said. “If I were to get blacklisted, I’d be totally screwed because there are no other clubs in San Francisco,” where she doesn’t feel pressure to do more than dance, “which is not my thing.”

“Or the Lusty Lady, which doesn’t pay enough to cover my bills,” she continued. “But Deja Vu is notorious for being a terrible company to work for, mainly because of their outrageously high stage fees.”

Other dancers say they had to pay stage fees at the Déjà Vu-owned Hungry I, and sometimes went home empty-handed after eight-hour shifts when uninvited touching was common.

“The number one thing that would improve our work experience is if someone actually forced Deja Vu to stop charging us stage fees,” Amber* said. “Almost no one outside the industry knows that dancers pay money to go to work. A lot of customers think the clubs pay us, like, thousands of dollars. In San Francisco we pay between $100–$200 per shift, sometimes more.”

By law, dancers have the right to choose employee status, versus being considered independent contractors. “But that’s a joke,” Amber added. “If we choose employee status, we’re required to do a minimum of 10 lap dances per shift. The club keeps all that money, and we would get paid $12–$15 an hour.”

But Edi Thomas, counsel for Déjà Vus Centerfolds club, flatly denies that the dancers who perform at Centerfolds (the only nightclub in San Francisco authorized to operate as a Deja Vu Showgirls club) pay stage fees.

Rather, entertainers who perform at Centerfolds (and/or at Hungry I, the Condor, and Market Street) are paid a substantial percentage of the patron revenues generated from individual dance sales, Thomas stated.

The entertainers are issued Forms 1099 at year-end, reflecting the amounts they were paid by the nightclub, she said, which means the dancers are independent contractors, not employees. These nightclubs operate within the law and make every effort to assure that entertainers are well compensated and perform in safe and lawful environments.

There are, as in any industry, former and disgruntled workers carrying a desire to harm a nightclub or the industry for their own personal reasons, Thomas added. “But those workers do not represent the voice of the majority.

 

CENTER OF THE STORM

When the Mitchell Brothers founded their empire, it was against a backdrop of organized crime trying to exercise a monopoly on the porn industry. According to a 1977 U.S. Department of Justice report, members of La Cosa Nostra tried to request exclusive distribution of Mitchell Brothers’ porn films.

The Mitchells resisted for years, but DOJ claims they eventually entered into a contract with LCN’s Michael Zaffarano to distribute “Autobiography of a Flea.” the Mitchells also fought City Hall.

During the 1980s, Mayor Dianne Feinstein’s vice squad tried to close the Mitchell Brothers’ operations. But under Mayor Willie Brown, the former attorney for late Déjà Vu strip club owner Sam Conti, SFPD enforcement reportedly eased.

Then in 1997, Déjà Vu started to take control of the city’s sex clubs, introducing stage fees and private rooms. In 2002, three former MBOT dancers filed their suit against Cinema 7. The next year, three other dancers brought suits against Market Street Cinema and Century Theater. And in 2005, Deja Vu settled a class action labor suit with its dancers. Attorney Greg Walston, representing the dancers, said at the time that minimum pay rate would protect dancers from being forced into prostitution to make money.

Deja Vu threatened a counter-suit based on the allegations of prostitution at their clubs, but Walston told reporters: “The record speaks for itself.” Walston used police reports with prostitution allegations to bolster his case and said he was doing the job the District Attorney’s Office should have done.

In July 2008, when MBOT reached its $3.74 million class action settlement, Cinema 7 president Jeffrey Armstrong said that the corporation was “not able to pay the entire amount up front.” Instead, Mitchell matriarch Georgia Mitchell and her business partner John P. Morgan, then cotrustees of the Jim Mitchell 1990 Family Trust, which holds two-thirds of Cinema 7’s shares, pledged stock certificates as security interest.

But the debate about how to treat sex work in San Francisco continues. In November 2008, District Attorney Kamala Harris and Mayor Gavin Newsom opposed Proposition K, a local measure that tried to decriminalize prostitution by forbidding local authorities from investigating, arresting or prosecuting sex workers. They argued that the measure would increase prostitution on the streets, give pimps cover, and hamper efforts to stop sex trafficking. The measure failed.

At the time, Prop. K advocate Carol Leigh and cofounder of the Bay Area Sex Workers Advocacy Network said, “We feel that repressive policies don’t help trafficking victims, and that human rights-based approaches, including decriminalization, are actually more effective.”

Today, erotic dancers must identify which of a tangle of regulatory entities is the appropriate venue to lodge complaints. District Attorney spokesperson Erica Derryck said Harris is dedicated to prosecuting violent crimes committed against all San Franciscans, regardless of whether they happen in a club or an alley.

“If there are two drug dealers and one attacks the other, we’d prosecute. But that’s not to say there won’t also be consequences for underlying criminal behavior too,” she said. “But anyone who has been victimized should be confident of going to the police and reporting any incident.”

Derryck said public health and safety complaints can be lodged at entities that provide permits and licenses, including the Planning Department and Entertainment Commission.

“There might not be any criminal activity involved, but this route hits clubs in the pocket and is worth considering if dancers want to represent their grievances,” she said.

Meanwhile dancers say there is still pressure to do more than just dance in some clubs. “For some dancers, the clubs feel fine,” Lorelei says. “It’s a safe space where no ads are needed. They see it as a fair exchange. But if you just want to dance — when one girl is doing this, and another that, how are you supposed to make money?”

Other dancers wish managers wouldn’t abuse their power. “Sometimes they back you up,” Amber said. “Other nights, someone insults you and they won’t help.” And many wish management would try to make the clubs fun again.

“It used to be a party, but now it’s about the cheapest dirtiest fuck you can get,” Lorelei said. “Taking stage fees created a dark environment that carries over to the customers. It’s like we’re goats in a petting zoo begging, saying give me money, give me coke.”

 

FAMILY BUSINESS

Attorney Jim Quadra, who represented the dancers in the MBOT class action suit, said that for all the talk about treating dancers right, the Mitchells’ interest was money.

“At the time, a group of people thought the agenda was to get dancers to do more than dancing because that’s what brings in the revenue,” Quadra said. “But Meta comes off much better than the rest of her family.”

During the trial, Jim was asked if there were meetings where Cinema 7 personnel defined what they meant by a “lap dance” in the piece rate system.

“You need a lap for a lap dance,” Mitchell replied. “You are getting down to like, you know, lap dance, erotic theater, America. And your question is like just a waste of the public’s slender resources, like drop[ping] a basketball in the ghetto and asking, ‘Did you define what that is for them?'<0x2009>”

Johnson, who voluntarily took the witness stand, was asked if there was any reason dancers would be afraid of her father. “He can be a little gruff and he can be cranky, a grouchy old man,” she replied.

Today Johnson is moving ahead with a vision she began to outline in 2007, then put on hold until December 2009, when a law suit about the family trust fund was settled.

“We settled everything out of court in December with my grandmother, which was a nice Christmas present,” she says, confirming that she and her siblings succeeded in removing their 83-year grandmother, Georgia Mae Mitchell, as trustee of the Jim Mitchell family fund. They replaced her with their mother, Jim Mitchell’s ex-wife, Mary Jane Whitty-Grimm, who also has custody of James’s baby daughter, Samantha.

“Danielle’s mother has some personal problems … that made the court reluctant to give her custody of the baby. so they gave Samantha to Mary, who is a nice woman, who is married with a family,” former San Francisco D.A. Terence Hallinan told me, after James Mitchell replaced him with another private criminal defense attorney, Douglas Horngrad, in March.

In court filings related to the family trust fund, Mitchell matriarch Georgia Mae claimed her grandchildren’s lawsuit was intended to deny her jailed grandson James his share of the trust to defend against his serious felony charges.

“Justin asked me to take money out of the trust account of his brother James, and send it to his mother instead of paying his criminal defense attorney, Terence Hallinan,” the Mitchell matriarch claimed.

I asked Hallinan if the trust fund was the reason James Mitchell changed attorneys. “Yes and no,” Hallinan said. “It definitely had to do with money and who was going to run the club. The poor grandma, she is such a nice person. She was trying to play fair and be nice to all the kids. It’s not a really healthy family. ‘Rafe’ [James] is where he is. In my opinion, he is still not clear what happened or why.”

Johnson, for her part, says her brother James has mental health issues. “I don’t accept what he did,” she said. “I’m not making any excuses for it. He’s either insane or he’s a monster. But the family has an obligation to make sure he has legal defense. He was always a beneficiary of the trust. But he fired his lawyer, which is the worst thing he could have done.”

A restraining order Keller secured five days before she was murdered claims Mitchell abused her for years, had mood swings, used cocaine, and was addicted to methamphetamines.

“Danny should have left,” Johnson said.

It’s been painful to read the comments people leave,” she continued, referring to online reaction to her brother’s arrest that suggest the Mitchells are bad seed and should be wiped out. It’s not because James is a Mitchell, or because there’s some bad gene.”

Rather, she said he had serious unaddressed problems, “a time bomb that was going to explode and then it did in just about the most horrific way imaginable.”

“When I was 13, my father shot my uncle Artie. And when I was 31, James killed Danny,” she adds. “So I hope I don’t live to be 103.”

 

WOMEN’S WORK

In 1985, the O’Farrell Theater’s marquee famously read, “For show times call … ” followed by Mayor Feinstein’s phone number. But that was another era.

“I don’t know Dianne Feinstein,” Johnson says, as she shows me a cartoon R. Crumb drew in 1985 of then-Mayor Feinstein as Little Bo Peep, with a bunch of men, including political and law enforcement leaders, peeking out from under her skirts. “I know my father was never very fond of her. And I’m sure her reasons for wanting to shut the club down were based on the idea that women are being exploited and that we need to save them.”

Johnson says some of their dancers are single moms; some are young girls who can’t get enough work at retail jobs to pay their bills; and others are college students and graduates.

“There are as many stories as there are dancers. But the stereotype is that dancers are being exploited and have to be protected because they can’t protect themselves and no one really wants to dance. But when I came through the club door, I realized that many women want to do this and get upset if people try to save them. Some people feel that working in a strip club is bad, wrong, dirty. No. But it can be if you are pushed into it and don’t want to do it.”

Dancers the Guardian spoke to confirmed that they dislike being framed as victims. When we are painted as victims, we look stupid, Lorelei said. All we want is to make sure that folks are following the labor code and providing the same basic, decent working conditions youd get if you were working at a coffee shop.

But dancers know that some people are titillated by the idea of women being taken advantage of. “They don’t want that fantasy to go away, that she’s really a good girl and doesn’t want to do it,” Lorelei said. “If it turns out we are not traumatized, horrified, or disenfranchised, it ruins the whole fantasy.”

She fears that political leaders know bad things are happening but don’t want to talk about them for fear it implies they are permitting them. “The attitude is these women aren’t real, they are sex workers, so if they get raped or go missing, who cares?” Lorelei claimed. “We can’t admit they are the babysitter, the girl who sits next to you at the office.”

When Johnson began working at MBOT, she was shocked that the dancers were naked. “But no one is forcing anyone to be here,” she says. “Sure, some women dance out of necessity. But there are women who are really into it … What’s bad is the exploitation.”

It’s hard to tell from the outside whether the MBOT dancers are feeling better about their working conditions these days or whether having a woman in charge makes a big difference.

On a recent Saturday night, we were charged $40 to enter the club. The ticket gave us access to the theater’s main stage, where a succession of ethnically diverse and athletically built girls pranced, pole danced, and eventually took it all off — in tasteful fashion — as the customers threw tips on stage.

A friendly girl asked if we’d like some company but backed off gracefully when we declined to do more than chat. No one else tried to hustle us for the next hour, and we didn’t get the sense that these women were desperate to make more money. The private rooms remained empty during our visit. But there are VIP rooms that we didn’t have access to, and it’s possible more hardcore stuff was going on elsewhere in the club.

As we left, a tour bus pulled up outside, full of tourists who pressed their noses against the bus windows to eyeball the famed Mitchell Brothers establishment, drawn just to gawk at this titillating and complicated San Francisco institution.

Johnson and Mitchell believe their club gives women a path to financial independence and that having a female in charge makes a difference. They don’t need a man,” Johnson says. “In most strip clubs, the pay is all under the table, and the girls keep cash in shoe box under the bed.”

“Dodging the IRS,” Mitchell adds.

But they recognize that some dancers may be coming from abusive situations. Johnson said she realized one dancer was in trouble when she asked to be booked for every shift. “I looked at the situation and saw 16-hour days in stilettos and an exhausting schedule. It took a woman’s insight to work out what was going on.”

“It goes back to a woman’s touch, ” Mitchell says.

Johnson blames this nation’s puritanical roots for the abiding disapproval toward the sex industry and those who work in it.

“But it’s come a long way,” Mitchell interjects.” When this place first started, it got raided non-stop. Now it’s much more acceptable than 20 years ago. In the next 20 years, I’m optimistic that prostitution will be decriminalized, at least in our city, if not in our state.”

So is prostitution happening as much as some dancers say it is? “You can’t penalize people for surviving,” Johnson says. “What dancers do outside clubs is their business. We don’t have control over them. All we can do is worry about them. We don’t condone illegal activity inside the club. We don’t encourage or support it. That’s our official take.”

Johnson acknowledges the O’Farrell Theater may have the reputation for being perhaps the most hardcore club in the city. “But everything that happens here, happens elsewhere,” she says. “It’s the same exact deal except they don’t care at all, and we’re a family-run business.”

Mitchell observes that the O’Farrell Theater is huge part of the city’s tourism industry. “When conventions come through, we’re one of the prime tourist spots, along with Fisherman’s Wharf and the Golden Gate Bridge,” he said.

“San Francisco is known for its freewheeling sexuality, like the Folsom Street Fair,” Johnson adds. “People say San Francisco is Oakland’s slutty sister. And people come here because this club is an institution, a landmark in San Francisco.”

So can Johnson make a difference against this convoluted backdrop?

“It’s a benefit to have a female in management,” Johnson claims. “When we come up with an idea, I think: How will the dancers feel? We’re on the same team. I treat them like teammates. We’re not in a battle over who gets the most money. I can see through things. Women manipulate men, and dancers are in the business of manipulating men. It’s a sale. It’s a hustle. They have that mindset. But I say, no, you don’t need to make up situations. You just tell us what’s up. But that’s not the normal attitude. In most clubs, it’s ‘Shut up, do what we say, and pay your fees.'”

Johnson says she was recently at the AT&T store, and the girl asked where she worked. “I said, at a strip club. People find that incredibly interesting. This girl was 23 and she was not comfortable with the idea of dancing, but at the same time she was fascinated by it. And it’s not going away, women dancing and stripping, You can hate it; you can love it — it doesn’t matter.”

After so many years on the San Francisco scene, MBOT is striving to be a legitimate part of its neighborhood and the city’s business community. And to Johnson, some of that involves unfinished business.

Lou Silva was the artist who did the original mural of whales on the clubs wall. Thats what I remember as a child. My dad and uncle were connected to that community and the underground comic movement in the late 1970s. They made money, they wanted to spread the love around, so they did a giant art project on the side wall. And a couple of years before my uncle died, they started to redo it. But the project stopped when my uncle was shot. We are going to bring the whales back. Were working on it with an Academy of Art class. It will be far more peaceful and calm than a crazy jungle scene on the wall. We want to redo whales to demonstrate that we are interested in more than just sex and exploitation. We want to be connected to our community again.

Noting that the new mural is part of the beautification of Polk Street, Johnson concludes: The mural on the wall is unfinished because of Arties death. Now its time to finish it, not to have unfinished art on the wall because of some horrible, violent incident. Its an investment to show we are not the Mitchells everyone thinks we are.

Drills, baby, drills

The disastrous Deepwater Horizon oil spill in the Gulf of Mexico should be viewed as a wakeup call for the San Francisco Bay Area, Pacific Environment’s Jackie Dragon noted at a May 11 forum on oil spill preparedness and prevention.

The forum was planned even before the April 20 explosion of BP’s rig, triggering the onset of an out-of-control oil spill that has continued to wreak havoc in the Gulf for nearly a month. Up to 100,000 barrels of oil a day could be gushing from undersea pipeline, according to the highest estimates, which would dwarf the damage caused by the 1989 Exxon Valdez spill in Alaska.

Investigative reports in the New York Times in the wake of the spill revealed that the Minerals Management Service (MMS) had issued deep water drilling permits in the Gulf without obtaining permits from a federal agency that assesses threats to endangered species — in violation of federal law — and that MMS routinely overruled staff biologists’ safety concerns. The reports suggest the failure of not only a mechanical device, but an entire regulatory system, in which oil company interests appeared to take precedent over public safety and environmental concerns.

Here in California, environmentalists breathed a sigh of relief when Gov. Arnold Schwarzenegger withdrew his support for Tranquillon Ridge, a controversial offshore oil drilling project planned off the coast of Santa Barbara. Yet the governor’s change of heart doesn’t safeguard California’s coastal territories from a spill. Millions of gallons of oil are transported in and out of the ports every year, and refinery infrastructure dots the coastline.

“It’s all about the initial timeframe,” noted Fred Felleman, an environmental consultant who spoke at the forum. Shaken by BP’s colossal blunder and wary of the string of failures that led up to last year’s Dubai Star oil spill, environmental groups are now pushing for legislation they hope will slash response time by requiring ships to deploy protective boom before pumping fuel, so potential spills could be sopped up immediately.

The precaution would do little to remedy a major spill, however, and it’s just a small piece of a wider response puzzle that entails coordination among volunteers, community groups, and multilevel government agencies to accomplish everything from containing the slick, to cleaning beaches, to caring for impacted wildlife.

Although established protocols and a chain of command are in place for responding to oil spills, several speakers at the forum noted that vigilance tends to wane between these catastrophes. The environmental devastation in the Gulf could prove to be a catalyst for investing more energy and resources into safeguarding against the worst.

 

LESSONS LEARNED?

Fortunately, the Bay Area has been spared from the sort of devastating blow that is blackening Gulf of Mexico waters, crippling fisheries, and sending tar balls ashore. However, the bay has weathered two comparatively minor oil spills in the last three years, which could be viewed as learning experiences for a bigger incident.

The Cosco Busan spill occurred in late 2007, when a cargo ship hit the Bay Bridge under foggy conditions and released 58,020 gallons of bunker fuel into the bay. According to a detailed account of the incident response, the vessel collided with the Bay Bridge at 8:30 a.m., and the fuel leaked out in a matter of minutes. Two hours later, the estimated amount spilled was reported at 10 barrels (420 gallons), and hours passed before the actual quantity was revealed. The state official who determined how much had leaked arrived at Yerba Buena Island at 9:45 a.m. to perform an assessment but had to wait more than two hours to be transported to the ship.

Speaking at the forum, Zeke Grader, of the Pacific Coast Federation of Fishermen’s Associations, said fishing boat captains with vessels at Fisherman’s Wharf were ready to be deployed instantly to help contain the spill — but the Coast Guard initially turned them away. “This was a relatively minor spill in a bay, and we were totally unprepared to deal with it,” Grader charged. “That is really egregious.” Commercial fishing vessels were finally deployed to help with efforts, most venturing out on day five — long after the damage had been done.

San Francisco Baykeeper, a pollution watchdog group, was inundated with thousands of phone calls from volunteers, but the lack of an overarching volunteer coordination plan between governmental agencies and community organizations made it difficult to plug people in, executive director Deb Self noted. The Office of Spill Prevention and Response (OSPR) is the state agency under the Department of Fish and Game that works in conjunction with the U.S. Coast Guard and the financially responsible polluter to react when a spill occurs. Carol Singleton, an OSPR spokesperson, acknowledged that better communication during the Cosco Busan would have made the response more effective.

The spill affected the Bay Area’s biologically rich ecosystem. Just 421 of the roughly 1,000 oiled birds recovered by volunteers were successfully rehabilitated and released back into the wild, according to the Golden Gate Audubon Society, while nearly 7,000 are estimated to have died. Even a small drop of oil on the feathers of a bird can destroy the animal’s natural insulation, resulting in hypothermia.

Singleton said a well-established oil-spill response strategy is in place. “Every vessel and every facility has a contingency plan,” she noted. “We’re constantly practicing.” Since the Cosco Busan, a volunteer coordination plan has been crafted, she said. Ecologically sensitive areas are mapped out and prioritized, and a network of wildlife care facilities stand ready to take in oiled animals.

Following the Cosco Busan spill, members of the Legislature put forth a suite of proposals that came to be known as the “spill bills,” resulting in a few stronger protections such as spill-response equipment stationed and ready for deployment in high-risk areas, enhanced funding to care for oiled wildlife, and grants to local governments for oil-spill response tools. However, some ideas for stronger protection got killed by Schwarzenegger’s veto pen.

Former Sen. Carole Migden proposed a mandatory spill response time of two hours, but that was vetoed. Sen. Loni Hancock proposed beefing up the state’s Oil Spill Prevention Administrative Fund, which is derived from fees on barrels of oil transported into California ports, by upping the charge from 5 cents to 8 cents per barrel. That was also struck down, as was Sen. Mark Leno’s proposal to establish grants to develop better containment and cleanup technology.

As the disaster in the Gulf continues to unfold, Dragon of Pacific Environment said grassroots environmental organizations might renew pressure for stricter regulations on some of these fronts.

 

TIMING IS EVERYTHING

Another piece of legislation, inspired by the Dubai Star oil spill, is expected to go before the Senate Environmental Quality Committee in early June. The Dubai Star mishap occurred last October when at least 400 gallons of bunker fuel was released into open water near Alameda.

Far smaller than the Cosco Busan incident, the Dubai Star spill still resulted in the deaths at least 100 shorebirds. It happened at Anchorage 9, two miles south of the Bay Bridge, during a fuel transfer — a routine fill-up that occurs roughly 800 times per year.

The official investigation report hasn’t been released, but U.S. Coast Guard Captain Paul Gugg noted that a faulty valve was to blame. Some 2,000 gallons of oil overflowed, but went unnoticed until someone aboard a tugboat pointed it out, according to Gugg’s account. Most of the oily mess was contained on board, but between 400 and 800 gallons spilled over the port side, instantly creating a toxic plume.

“This particular vessel is equipped with high-level alarms, and high high-level alarms, which did not activate,” Gugg noted.

Under state regulations, vessels are required to respond to spills by deploying 600 feet of boom within 30 minutes, and 600 more feet more within one hour. In the case of the Dubai Star, that didn’t happen, a report released by the San Francisco Estuary Partnership noted. Instead, the slick was allowed to spread.

Assembly Member Jared Huffman (D-San Rafael) introduced AB 234 to establish a requirement for vessels to deploy boom before beginning a fuel transfer, so that a spill could be contained without losing time. The state of Washington has a similar law, noted legislative aid Paige Brokaw, “and their current conditions are pretty similar to our current conditions.” Booming is only effective at slower currents, which makes things difficult since a fuel transfer can take more than eight hours, and currents may shift in that time.

Huffman’s office received a letter of opposition to the bill from OSPR. “Booming is a good method to contain a spill, but it’s not a foolproof method,” said Singleton, the OSPR spokesperson. “To use that one method, it just may or may not work in certain circumstances.” Nonetheless, proponents of the bill say that even partial oil containment in higher currents is better than having no precautionary measures at all.

While the lessons of the past can be instructive, forum participants noted that continuous coordination, communication, and vigilance is the surest path to being able to respond if another oil spill occurs in the Bay Area. Grader, meanwhile, said he knew the best solution of all. “The ultimate prevention,” he said, “is basically getting off our oil addiction.”

BP still claiming exploded oil rig was safe and reliable

The corporate communications industry has gotten so ridiculous, so disconnected from reason and a sense of shame, or an obligation to provide some semblance of truth or credibility, that it’s amazing we still listen to these people at all anymore. And the best example of that right now is BP, the oil giant that is well on its way being responsible for the worst oil spill in history.

Beyond the sheer magnitude of this Gulf of Mexico spill, there have been well-sourced media reports that political appointees in the regulator agencies ignored the warnings of Minerals Management Services scientists that a devastating spill was a real possibility and that even BP employees warned that a spill could happen and that internal documents were a mess.

But rather than simply accepting responsibility and their newfound infamy and humbly trying to make amends, BP’s flaks have instead been sending out regular press releases attacking the media reports and making claims that this rig was safe, well-operated, and aggressively regulated – all evidence to the contrary.

“As CEO Tony Hayward constantly makes clear, safe and reliable operations are his number 1 priority for BP and the company has a very strong record of safe and reliable operations in the Gulf of Mexico,” the company wrote. “It is completely erroneous to suggest that the minor internal process issue we identified and immediately amended last year on the Atlantis platform suggests anything different.”

Sure, our rig blew up and created an oil gusher that we have no idea how to stop, but that doesn’t mean we aren’t “safe and reliable,” right? Um, actually it does, otherwise this wouldn’t have happened. BP even tries to claim credit for the fact that this spill didn’t happen even earlier.

“The Atlantis field has been in service since October 2007 and has safely produced many million barrels of oil. The platform was successfully maintained through the course of two major hurricanes in 2008. Its safety, operations and performance record is excellent,” they wrote.

Sure, right up until it was terrible. But even now, with the irreparable devastation this company has caused, they are also trying to sound like good guys for generously offering to pay for some of the ancillary damage they caused. Here’s what the company sent out under the cheery heading, “BP Announces Tourism Grants to Four Gulf States”:

“BP is today announcing grants to each of the states of Florida, Alabama, Mississippi and Louisiana to help their Governors promote tourism around the shores of the Gulf of Mexico over the coming months. This is part of our ongoing commitment to help mitigate the economic impact of the oil spill.

BP is providing $25 million to Florida and $15 million each to Alabama, Mississippi and Louisiana. “The Gulf Coast is our home too. We are doing everything we can to plug the leak, contain the spill offshore and protect the shoreline.  With the deployment of the riser insertion tool yesterday, we made important progress in containing the spill, and that will further strengthen our ability to keep oil off the shore,” said Tony Hayward, BP’s Group Chief Executive.

Sure, BP and their allies in the oil industry and the conservative movement put a cap of $75 million on how much the U.S. government can make oil companies pay to clean up their messes, but they’re happy to promote the area they marinaded in crude oil as a tourist destination. This is a weird world we live in.

An environmental and worker disaster

It‘s coming up on 10 o’clock in the evening aboard a massive oil rig, the Deepwater Horizon, 130 miles off the Louisiana coast in the Gulf of Mexico. It’s Tuesday, April 20. The rig sways gently in the calm waters. Then, suddenly . . . BOOM!

A huge explosion rocks the rig, releasing tons of oil that soon will spread over an area of at least 2,500 square miles. Of course it’s an environmental disaster, probably the worst oil spill ever. That’s what draws massive attention from the media. But what of the workers aboard the rig, who suffered terrible trauma, serious injury and death?

Too often, the mainstream corporate media all but ignore workers’ suffering in such disasters. They sometimes seem more concerned with the degradation of the environment than with the suffering of humans. They focus almost solely on the environmental damage, and its cost to those who employ the workers.

Too often, the workers are treated as mere numbers. Eleven dead, 17 injured, said the media accounts of the Deepwater Horizon explosion.  But just what does that mean? Precisely how were the workers made to suffer? Might they suffer in the future because of their injuries? What can and should be done to make future work safer for them and others? The mainstream media rarely ask such questions. Working people, be they on land or sea, are of secondary concern to them.

The explosion was horrendous. It turned the Deepwater Horizon’s deck into what one worker described as “like a war zone.” One of his co-workers told of seeing “guys burning” and “some guy missing limbs.” The scene was indeed what he recalled as “extremely gruesome.”

Flames from the burning oil shot into the sky, high as a multi-story building, as some of the 126 people on board leaped overboard to reach lifeboats waiting in the water 80 feet below. It took 45 minutes for Coast Guard rescue boats and helicopters to reach the rig, the heat of the oil flames so intense by then it melted paint off the rescue boats.

Some survivors were rescued by a supply ship operated by British Petroleum (BP), which had leased the Deepwater Horizon from the Transocean corporation. Seven BP executives who were on board were injured, but that didn’t move them to express any concern for the future safety of their employees.

Transocean, meanwhile, has tried to keep the workers from filing for legal judgments that would grant them compensation for any alleged negligence that caused the explosion and for any psychiatric problems and other injuries that stemmed from the blast.
The workers were rushed under employer escort to hospitals and a New Orleans hotel immediately after rescue and not allowed to contact their families or anyone else who might advise them on whether they should agree to initial forms that Transocean lawyers insisted they initial.

The form said in effect that the worker had been on the rig when it exploded, but had seen nothing or did see something and was or was not hurt.

In the meantime, the media continue to report in detail about the serious effects the explosion has had on the environment while all but ignoring its serious effects on the workers involved.

To concerned environmentalists, the accident is yet another strong argument against the folly of offshore oil drilling, But a more immediate concern should be the dangers faced by workers involved in the continued drilling. For if the drilling is not to be halted, there’s a great need for much greater safety procedures.

Accidents have taken the lives of nearly 70 oil rig workers over the past nine years, including the 11 who died in the Gulf of Mexico. Protect the environment, yes.
But first, protect human lives.

Oil spill secrecy: What’s in the dispersal chemicals?

One the major responses to the Gulf of Mexico oil spill has been the use of chemical dispersants, compounds that break up the oil before it gets to shore. But Propublica’s raising an important issue:


Dispersing the oil is considered one of the best ways to protect birds and keep the slick from making landfall. But the dispersants contain harmful toxins of their own and can concentrate leftover oil toxins in the water, where they can kill fish and migrate great distances.


And the sharp-eyed sunshine advocates at the Sunshine in Government blog picked up on another element of this: We don’t really know how dangerous the chemicals are — because even though BP is dumping vast amounts of the stuff into the ocean, the dispersant formulas are secret:


In situations where the public interest in knowing what science can tell us about the chemical product we’re blasting into the Gulf of Mexico in a vast, untested experiment to stop a petroleum hemmorage in deep waters that threatens life in nature and livelihood in the Gulf Coast, the federal government, private companies and the industry they are a part of ought to do the right thing and make public all  the science they’re holding that sheds light on how the government and private sector are responding to this very current environmental and economic crisis.


Now, the sources I have in this clean-up tell me that the dispersant is a lot less toxic than the oil itself — but there are no long-term studies on the damage it might do to deep-sea biota and to the larger ecosystem. Not that they should stop dumping the stuff — it’s probably the best alternative, given a lot of bad alternatives — but since BP is taking responsibility for the spill and cleanup, we ought to know what the impacts of this chemical solution are — because the company ought to be responsible for those, too.

DANCE If Deborah Slater had not grown up into an artist, she might have tried her hand at science. She bases her dance theater pieces on extensive studies of physical reality. Her inspiration can come from concrete objects like furniture (Hotel of Memories) and paintings (The Desire Line) or less tangible phenomena like sleep (The Sleepwatchers), perception (Passing as … The Mathematics of Being), and death (A Hole in the World). Accessing Slater’s works can take patience, but her creations stay with you because they are formally inventive, finely crafted, and engage the mind and heart long after you leave the theater. But rarely have the many strands she weaves together resulted in a piece as sprawling, ambitious, and poetic as her 20th anniversary premiere Men Think They Are Better than Grass.

Seen at a preview performance, Men — the title is not anti-male, but refers to humankind — takes on nothing less than the destruction of the environment that started probably as soon as humans were given "dominion" over the earth. Instead of reiterating well-rehearsed arguments, evidence, and position papers, Slater and codirector/dramaturge Jayne Wenger went to poet W.S. Merwin. Excerpts of his writings provide the backbone and scenario for this evocative, richly textured canvas of sound, color, language, and movement. The poetry, heard on tape and — helpfully — reprinted in the program, was recorded by a number of well-known Bay Area artists.

Men explores human alienation from nature in a series of imagistic episodes that, though loosely structured, build momentum. They are dark (dancers rushing about in increasing desperation), funny (Justin Flores transforming himself into a man made of briefcases), and dreamy (people trying to dig up the firm ground of history that proves to be unexpectedly porous). Perhaps most remarkable was the way Men deepened its sense of entropy, barely alleviated at the end by something, at least, suggesting a way out. As the piece darkened, the confrontations between the dancers, who had stripped off their business black to reveal battle fatigue greens, became increasingly agitated. They intensified to the point where they had a Lord of the Flies aspect to them. You also wanted to gasp for air every time the dancers crushed themselves into an ever-smaller piece of terrain.

Still, at this point, the choreography worked best in the small units: Travis Rowland heaving one woman after another, Private Freeman on a "war path" to protect his potted plant, and the fierce Kerry Mehling in anything she lent her regal body to. Some of the ensemble sections, particularly the unisons, needed more of a profile; they sometimes looked tense and rushed beyond what I think the intention was. All the dancers — Natalie Green, Kelly Kemp, Wendy Rein, Breton Tyner-Bryan, Shaunna Vella, and the others already mentioned — contributed to the choreography.

Men was a collaborative enterprise in other ways as well. Thom Blum and Floor Vahn’s soundscape of natural and animal sounds beautifully evoked the natural world, so increasingly absent in the lives of these depraved-deprived people. Elaine Buckholtz’ videography added its own poetry. Allen Willner designed the dramatic lighting, Laura Hazlett the fine costumes. What did not work was Mikiko Uesugi’s metaphoric use of plastic sheets for chopped-down trees. *

Reupholstering “Defenestration”

“Can you wait about fifteen minutes?” Brian Goggin asks as he climbs into the harness that will lift him up to the fourth floor of the abandoned building on Sixth and Howard. Out of respect for this remarkable artist (and rapt awe his elevation has on the observer), we wait, standing to the side on the pavement below. Goggin’s restoration of his iconic piece of public art, “Defenestration,” bears witnessing.
Since its installation in 1997, the piece has become a Fellini-esque addition to its rough SOMA street corner. Its canvas is large, rundown building, its doors and windows boarded up since the owner’s renovations stalled in the ‘80s from permit violations. Pieces of furniture — chairs, lamps, coffee tables with their telephones still clinging to them — fling themselves from the roof and windows, causing passer-bys to gaze upward, wary of falling sofas. It’s like a free for all from a sinking ship.

But the wooden legs are beginning to rot, the upholstery fraying and tearing from 13 years of exposure to the elements. The area’s been targeted in a beautification campaign, and the city recently seized the property, citing eminent domain. There are vague plans to tear it down to make way for more low income housing, along the lines of the flashy edifice that stands kitty corner to “Defenestration.” Goggin is determined to give the piece a last hurrah. “If the wrecking ball does come, at least it will be dressed up for the occasion,” he says, looking up at his masterpiece.

It’s a labor of love. Goggin had done other public art before, and since “Defenestration” (the flying books on Columbus and Broadway, “The Language of the Birds,” is another one of his works), but few pieces have captured the city’s imagination like the building on Sixth and Howard. He estimated it would take $75,000 to fully restore the work.

“I had done similar pieces before “Defenestration.” my piece “Herd Mentality” in the Yerba Buena Gardens is a bunch of Queen Anne tables climbing up a wall, jumping over, and running across the lawn — like a herd of wild buffalo roaming through the plains,” says Goggin of the providence of the leaping living room sets at Sixth and Howard. “This one I wanted to do in a neighborhood where people were finding creative ways to uplift their life.”

He originally envisioned the work on an occupied building, explaining to property owners in the area “all I wanted to do was drill big holes in their walls and stick furniture to them. None of them were interested.” Eventually, walking down Sixth Street he saw a sign with a number to call regarding interest in an abandoned building there. He called. The owner was away on a trip to Gujurat, but his daughter was intrigued by Goggin’s preliminary sketches of the project. “She told me I could install the piece if I could do it by the time her dad got back,” the artist remembers.

Eight months later, with the help of somewhere between 30 to 70 volunteers, “Defenestration” was up, making an impression on Sixth Street residents in the process.

One neighbor put a sign in their window that said “get out of the neighborhood art fags,” but for the most part, people were curious about Goggin’s leaping tables. “Everyone seemed to understand [“Defenestration”] without question,” says the artist. “They even started bringing me furniture. I appreciated their eccentricities, and they appreciated mine.”

We chat on the sidewalk while Goggin and his assistant, Valerie Levy, mix epoxy with rubber gloved hands. We are interrupted sporadically by people walking by with questions about all the pulleys and caution tape surrounding us.

“What, you’re tearing this down?” one man asks us in disbelief. “It’s been here for 35 years! It’s a landmark!” “102 years! We‘re putting up condos!” Goggin calls after him with a grin. It must be rewarding to see one’s work become such an accpeted feature in it’s environment.

Though he was working on the site nearly every day when he started in December, Levy and Goggin have cut back to two days a week after a beautiful exhibit of photos taken of the site that was held across the street at 1AM Gallery failed to raise sufficient funds. He’s collected $20,000 now, with an adjusted goal of $10,000 more. “The dream is to rent a boom lift,” Levy confides as she shows us around the interior of the building.

Entering into the gloom inside the metal door, the magic of the site is easy to absorb. Save for the original hotel lobby on the ground floor, it’s an absolute mess. Orange spray paint marks the rotten spots in the floorboards, walls have been knocked down, debris is everywhere. But the filth creates a certain, raw magic.

Large porcelain tubs remain from the SRO’s original residents. A natural camera obscura from holes in a boarded up window projects an image of the sky and buildings across the street, upside-down, on the wall. Pigeons have laid claim to entire floors, particularly the room with the dining room set one of Goggin’s friends arranged for a formal dinner party as a surprise birthday present for his girlfriend. The vast, “over engineered,” steel frames that secure the hanging furniture seem to be the only solid parts of the structure (“they had to do that,” explains Levy. “otherwise, you can’t really have sofas hanging over peoples’ heads”). The squatters that occupied the building before Goggin returned for restoration have cleared out, ingratiating his project to the managers of the property.

The whole thing has an air of the absurd.

Goggin has nurtured, and embraced the oddness of it all. Sideshow freak panels from the “Urban Circus” he threw in 1997 for the piece’s debut still cling to the walls outside and sit in stacks within the workshop.

“The question of restoration was one I pondered for a number of years,” he tells us, a bit tired from another trip up the wall to fix a coffee table. “I liked the idea of revisiting it, of going back to the community to see whether this was something they wanted, if it was important to them.”

But it’s clear, from the smile on his face, and they way he lights up to discuss the job, that “Defenestration” is important to Goggin, as well — a feeling that is contagious to those around him. “I’m interested in perpetuating the joy, fun, and absurdity of it all,” he concludes, and we leave him to his work.

Mexico warns citizens: use extreme caution in Arizona

It’s no surprise to anyone who has watched Newsom stubbornly refuse to take responsibility for the consequences of his flawed juvenile immigrant policy that the mayor is playing coy when it comes to the Board of Supervisors’ and the City Attorney’s attempts to institute a boycott of Arizona.


The real surprise in the fallout around Arizona SB 1070 is that the legislation doesn’t include a clause whereby all “aliens” must find a picture of the Arizona state flag, cut out the star in it, and wear it as a “badge,” much like the Nazis required of the Jews.


But Mexico does gets the threat this hateful legislation poses to its citizens. In a new twist on travel advisories, the Ministry of Foreign Affairs of Mexico has warned its citizens in Arizona to exercise extreme caution, whether they are demonstrating against Arizona SB 1070, going about their everyday affairs, attending classes or contemplating accepting work offered from a car on a highway.


“It is important to act with prudence and respect local laws,” the Mexican consulate states. It notes that the new law won’t take effect until 90 days after the end of the current session of the Arizona state legislature, but warns, “however, as was clear during the legislative process, there is a negative political environment for migrant communities and for all Mexican visitors.”


The consulate recommends that Mexican nationals carry available documentation, even before the new law takes place so as to “help avoid needless confrontations.”


“As long as no clear criteria defined for when, where and who the authorities will inspect, it must be assumed that every Mexican citizen may be harassed and questioned without further cause at any time,” the consulate states.


“The new law will also make it illegal to hire or be hired from a motor vehicle stopped on a roadway or highway, regardless of the immigration status of those involved. While these rules are also not yet in force, extreme caution should be used.”


The consulate concludes by reminding folks that “Mexican nationals who are in the United States, regardless of their immigration status, have inalienable human rights and can resort to protection mechanisms under international law, U.S. federal law, and Arizona state law. The functions of the five Mexican consulates in Arizona (Phoenix, Tuscon, Yuma, Nogales and Douglas) include providing legal advice to all Mexicans who consider that they have been subjected to any abuse by the authorities.”

-When shopping for new bedroom toys and teasers, look for products that were manufactured somewhere nearby, or at least ones that don’t require being shipped overseas.

-Choose natural materials and organic ingredients, just as you would for a feast– treats that won’t harm your insides or the Earth’s pretty parts.

Pioneers! O Urban Pioneers!

People are returning to land like it’s the 1970s all over again, but they’re not packing up for Vermont, letting their hair go au naturel, and unplugging from the grid to do it. Urban agriculture is sprouting up like, well, sprouts. And while we all feel strongly about sustainability and pay a lot of lip service to higher ideals, the majority of us probably aren’t willing to adopt the radical homemaker lifestyle and sacrifice cell phone coverage, The Colbert Report, or regular social interactions. The following cursory guide highlights a few urban farms in SF and immediate environs where you can volunteer or access food, as well as resources for cultivating your space in the concrete tangle (even if you live in a third-story apartment) and options for the time-honored tradition of gleaning.

 

MANY FARMHANDS MAKE LIGHT WORK

Community farms offer support not always available for the individual plots of community gardens (which typically have astronomically long wait-lists anyway), or even your own cramped Bay Area backyard. And for 60-hour-work-weekers, it might be taxing to grow more than a bit of basil or mold on that cheese in the back of the fridge. If you don’t have the time, energy, space, or inclination to follow famed urban farmer Novella Carpenter’s fantastic example (ghosttownfarm.wordpress.com), consider volunteering at the following places to satisfy your green thumb’s bidding.

As Chris Burley, the director of Hayes Valley Farm (www.hayesvalleyfarm.com) told me, “People are looking for a tangible way to get their hands dirty and address the impacts of our ecologically destructive, industrialized food system while doing something meaningful and connecting with their community.” And that’s exactly the goal that the farm, located off Laguna and Fell steets, has been aiming to fulfill since its inception as a way to revitalize an unused lot, once a freeway onramp, into a shared space.

Although the farm is still taking root, so to speak, the plan is to eventually grow enough fresh and organic food to feed the neediest nearby members plus the volunteers working to cultivate the space. Education also plays a major part in the function of the project, with Thursday and Sunday “work parties” where people can get that hand-dirtying experience, as well as regular classes on urban gardening and permaculture.

Altho Quesada Gardens Initiative (www.quesadagardens.org) primarily operates as a community-directed organization that seeks to strengthen the social systems of Bayview-Hunters Point, local food production has become one of the top concerns of the neighborhood. The resident-led nonprofit connects and maintain backyard farms and free food-producing community gardens throughout the area. In one of the neater facets of its food justice work, the group also helps maintain the kitchen garden of roving supper club Old Skool Café (www.oldskoolcafe.org), which employs at-risk or previously incarcerated youth. With such kick-ass people, it’s no wonder that urban farm hero Will Allen adopted one of the satellite gardens on his visit to the Bayview. Community volunteer meetings and gardening days tend to be informal, so e-mail for specific opportunities.

Sometimes the best things in life really are free. Located at Gough and Eddy on land kindly lent by the Lutheran Church, The Free Farm (www.thefreefarm.org) intends to give away 100 percent of its produce. Still in its initial development stages, the fledgling project welcomes volunteers every Saturday and Wednesday from 10 a.m.-2 p.m. to help with the launch. Working in tandem with its sister organization, The Free Farm Stand in the Mission also offers fresh fruits and vegetables donated by other local urban farmers. Although places like Little City Gardens (www.littlecitygardens.com) and folks who glean from public land contribute, the bulk of the produce comes from the 18th Street and Rhode Island (www.18thandrhodeisland.org) farm maintained by the SF Permaculture Guild, which offers volunteer opportunities as well. With a goal to sextuple the farm’s output within the next five years, it could probably use a little bit more help. Work days are on Friday.

For West Oakland residents, two nonprofits have been power-housing to combat the food desert that plagues the area. City Slickers Farms (www.cityslickerfarms.org) operates several all volunteer-run farms throughout the neighborhood that could always use a few extra work hands. Collectively these six lots cultivate ducks and chickens, bee hives, veggies, fruit trees, and medicinal herbs, the produce of which are distributed through the Saturday Farm Stand on a sliding scale or work-trade basis — no one’s turned away. And if you still have a mighty urge for some composting, weeding, planting, and mulching, People’s Grocery (www.peoplesgrocery.org) runs three farms that constantly need tending. The 55st Street location tends fruit trees, culinary herbs, and vegetables; 59th Street is a slightly less cultivated space in collaboration with Berkeley’s Spiral Gardens Community Food Security Project (www.spiralgardens.org), which runs its own food garden off Oregon and Sacramento streets for you West Berkeleyites. People’s Grocery’s newest land acquisition, the plot behind the California Hotel off of 35th and Chestnut streets, hosts a greenhouse and a biointensive microfarm that replaced its 3.5 acre Sunol site last January.

 

HOME SWEET URBAN HOMESTEAD

If you have access to private land to cultivate, or even if you don’t, the following resources will set you on the path to food freedom. These classes, demonstration sites, and professional landscaping services will help you turn backyards, rooftops, and even windows into humming generators of small-scale urban agriculture.

Before you even think to take a shovel to your virgin backyard or start a worm bin, visit Garden for the Environment (www.gardenfortheenvironment.org). A one-acre demonstration garden in the heart of Golden Gate Heights that also teaches organic food production and sustainable landscaping with weekly workshops, you can see how it’s done before trial-and-erroring on that graywater irrigation system or chicken coop. The resource directory on its Web site also serves as an invaluable aid for at-home troubleshooting. Hotlines for gardening and composting issues, where to find recycled lumber, how to test your soil, manure suppliers, wasp removal companies — it’s all there.

DIY food production classes abound everywhere in the Bay Area but the one-stop shopper won’t find a better resource than the Institute of Urban Homesteading (www.iuhoakland.com) in Oakland. It offers a comprehensive curriculum ranging from beekeeping, butchery, goat farming, brewcraft, herbal medicine, bread making, fermentation, berry patches, and other topics of the same ilk. It’s a real crash course in manifesting your inner Laura Ingalls Wilder. With no central location, classes are taught in the teachers’ homes, which presents a neat opportunity to see real-time urban homesteading and the different ways people create sustainable places in an urban setting. Also consider Urban Kitchen SF (www.urbankitchensf.com) and BioFuel Oasis (www.biofueloasis.com) in Berkeley for supplementary courses.

If you’re feeling overwhelmed and green behind the ears, several services will landscape your yard into a cornucopia of organic delectables and even continue the maintenance if you just can’t do anything with that black thumb of death. Star Apple Edible Gardens (www.starappleediblegardens.com) provides a range of services throughout the Bay Area, the simplest being consultations and composting tutorials. You also can order ready-made kitchen gardens or go whole kit and caboodle and have customized “garden design and installation, pathway and hardscape installation, irrigation design and installation, planting, plant feeding and cultivation, regular harvesting of your garden crops, and design, installation, and maintenance of composting systems.” Other similar businesses include All Edibles (www.alledibles.com), which specifically works with East Bay dwellers, and Chris Sein of Wildheart Gardens (www.wildheartgardens.com), who also consults on backyard chickens and mushrooms.

For a lot of us in the Bay Area, the dream of having a backyard is about as likely as Glenn Beck admitting that Obama is not a herald of an impending Orwellian dictatorship. So what can the more dispossessed among us do to return to the soil? Popular in Europe and becoming more so here, rooftop gardens are a great solution to space issues. Graze the Roof (www.grazetheroof.blogspot.com), the community vegetable patch on top of Glide Memorial Church, hosts rooftop gardening workshops. You can also gain experience by volunteering on work days every Thursday or first Saturdays. For those feeling less than philanthropic or sociable, pop over to your local bookstore to pick up the Use Your Roof Guidebook by Bay Area Localize (www.baylocalize.org). Seven bucks and four easy chapters gets you on your way to a more edible roof.

For balcony-less apartment dwellers, and maybe those with vaulted ceilings, window farms have become the new rooftop gardens. An open-source project that’s evolved over the past year, Windowfarms (www.windowfarms.org) gives how-tos for its innovatively cheap and space-conscious hydroponics system — jerry-rigged from repurposed plastic water bottles, tubing, and fish tank pumps that hangs in vertical columns in the window — as free PDFs on its Web site. It also hosts community boards where members share improvements to the system, which is constantly being updated. Alas, window farms can only really successfully raise leafy greens, but having a homegrown salad in a studio apartment is still pretty darn amazing.

If you already have your urban farm bustling along — or even just a prolific citrus tree — then yard-sharing is a great way to spread the fruit of your labor throughout the community. Neighborhood Fruit (www.neighborhoodfruit.com), SF Glean (www.sfglean.org), and Produce to the People (www.producetothepeople.org) will gladly help you to unload the excess bounty and distribute it to the hungry.

The Guardian has been periodically producing the Board of Supervisors’ Good Vote Guide for many years, tracking where our elected representatives come down on important issues. And unlike a similar poll recently put out by the San Francisco Chamber of Commerce, which chose 10 votes designed to promote deregulating and subsidizing big businesses, we chose items important to the broad public interest.

The 20 votes we selected this time reflect our concerns for protecting tenants, funding vital public services, safeguarding civil liberties, promoting small businesses and nonprofits, appointing qualified people to commissions, and valuing the environment more than “green” press releases and corporate profits.

The O word

VISUAL ART There is no doubt that “James Castle: A Retrospective” is a treasure trove. On view at the Berkeley Art Museum, this comprehensive gathering of the self-taught artist’s many and varied works would be utterly overwhelming if its many miniature pieces and slight changes of form and approach didn’t encourage a certain freedom on the viewer’s part. In this regard it’s quite different from the recent traveling Joseph Cornell retrospective that had a stay at SFMOMA, where in a single viewing Cornell’s box constructions quickly became exhausting to engage with due to the sheer relentless volume and repetition of the presentation.

Cornell’s name is a charged one to evoke in relation to Castle, because just as one could — though perhaps few writers do — draw comparisons between the artistic themes and tactics of Cornell’s art and the art of Henry Darger, Castle also shares some traits with Cornell (and, in turn, with Darger). In the realm of Castle, it is helpful to flip the script so to speak, and see that whereas Cornell is renowned for his boxes, Castle frequently turned box material — cardboard — into imaginative open space. Of course, a certain invisible wall separates, or separated, the eccentric but successful Cornell from Darger, who toiled in near-absolute obscurity and isolation, and from Castle, a deaf man who created at home in a familial farm environment with little public recognition until late in his life.

Which brings us to the word outsider, ever-present in art-speak during Darger’s 1990s rise to posthumous cult stardom, yet curiously absent from the majority of writing about Castle. To be sure, notions of outsider art far predate Darger, even if he has become its best-known recent representative. Roger Cardinal’s book Outsider Art, first published in the U.S. in 1972, catalogs its definition of the term, with an emphasis on outré words such as madness and primitive, and a focus on violent creative forces such as Adolf Wölfli. With the coronation (however rightful) of Darger, it’s as if outsider art became cuter, with even Darger’s romantic and gender-bent view of little girls discussed in relative terms of endearment. Kid gloves, as it were — since Darger was so thorough an outsider, locked in imagination instead of literal action, he was safe.

No such illegal undercurrent runs through Castle’s work, even if, like Cornell and Darger (and a plethora of artists and other human beings today) he recreates pop images of childhood and innocence. But the measured focus of the meticulous and valuable discourse around Castle’s work — traits shared by Tom Trusky’s biography James Castle: His Life & Art; Jeffrey Wolf’s documentary of the same year, James Castle: Portrait of an Artist; and editor-writer Ann Percy’s monograph for the Castle retrospective — risks the creation of an overtly (perhaps the t should be subtracted from that last word) self-aware viewpoint. The evidence is in the flatness of the titles. If Castle is to claim a rightful place among great American 20th-century artists, here’s to future dialogue about him that allows for the same irreverence and uncensored opinion afforded those who were wined and dined and made megabucks. In addition, he could be spoken of in the same breath as talents as disparate as Darger and Wölfli in a manner that rescues outsider art from shame-based erasure.

The aforementioned o word doesn’t appear until the halfway point of James Castle: A Retrospective, which also rejects the idea of Castle as folk artist. (Interesting, since Darger’s commercial apex has occurred with New York folk museum realms.) Even then, it’s placed within conversational quote marks by the painter Terry Winters. Encouragingly, Winters later flips the notion and mentions “insider” art, a notion that probably is intended in commercial terms, but could just as easily signify those artists whose creative life has an inbuilt insularity. For now, the atmospheric and perhaps emotional darkness of so many of Castle’s soot-and-spit works is in the light, and it would be an honest mistake to view those works as cute. His books, assemblages, and drawings are as complicated as the people they render, and possess as many open doors as the houses or homes they depict.

San Francisco’s Potrero del Sol Skatepark is often packed with skaterboarders, a testament to the sport’s popularity and to the dearth of places in the city where it’s legal to skate. But that will soon change with the city’s commitment to build two new skateparks: one in SoMa and the other in the Haight.

Both have been tentatively approved by the Board of Supervisors. But before any concrete is poured, the skaters will have to overcome budget crises, angry homeowners, and their own bad reputations, particularly in the Haight, where the proposed park has gotten caught up in the furor over vagrants and the proposed sit-lie ordinance.

San Francisco has long been a skateboarding hub, yet there’s always been friction with police, businesses, and everyday city life. Even though it’s legal, there just aren’t that many places to do it anymore, partially because the city and property owners routinely attach barriers to any surfaces that might be appealing to skaters.

Skateboarders, long accustomed to being ignored and disenfranchised, have responded in their usual DIY fashion, such as building a few obstacles in an empty parking lot under a freeway overpass. The city took notice of the demand and after three years of planning and meetings, the newest of San Francisco’s skate parks has finally been allotted the necessary funds to begin construction around the end of summer.

The Central Freeway Skate Park will be located in what is now a parking lot at the intersection of Duboce and Stevenson streets in the north Mission District area. With $2 million collected through the Central Freeway Corridor Housing and Transportation Improvement Act of 1999, which provides for the sale and lease of parcels of city land that were under the now-demolished freeway, officials plan to develop the park to eventually include basketball courts and a dog run.

Rich Hillis of the Mayor’s Office of Economic Development said the city is considering a variety of improvements, but confirmed that “we think the skate park is the priority.” He attributes the park’s relatively unopposed approval to the demands of the city’s skaters and to the community as a whole. “They embraced the idea of a skatepark early on,” Hillis said of the forward-thinking residents of the area. He jokingly adds that the park should be named “Hornbeck Park” after Bryan Hornbeck, director of the San Francisco Skateboard Association. Hornbeck and his associates started the SFSA to push the city to build new parks designed with skaters in mind.

“San Francisco has to have a world-class skatepark,” Hornbeck said at one of the many skate events his group organizes. Hornbeck said the city has been receptive, working with skaters on the design of the park, but left SFSA to organize skaters and raise the funds. “It’s bake sale; it’s lemonade stand; it’s the best we can do,” Hornbeck said. “We’re not trying to take anything, we’re trying to make our own thing.”

Plans for the park, drawn up by notable skatepark design firm New Line Skateparks, are currently under review by civil engineers. After the plans are finalized, the project will be bid out to find a contractor. Tentative 3-D renderings have been online for months, sparking heated debate on skateboarding Web sites.

When the acclaimed Potrero del Sol Skatepark opened in 2008, many skaters felt that while it was well-designed and enjoyable, it didn’t have enough terrain that mimicked street riding. New Line has designed a number of skating plazas, most recently in Los Angeles. Its involvement gives many skaters hope that the new park will incorporate obstacles that represent the city’s rich street skating history.

But things are not moving as swiftly for the city’s other planned skate park, just beyond where Waller dead-ends at Stanyan in the Haight, which doesn’t have the same guaranteed funding stream. While bids for a design have been submitted, the Recreation and Park Department needs to get approval for $1 million–$2 million in construction funds before moving forward. The city proposed the 120,000-square-foot cul-de-sac at the end of Waller and next to SFPD’s Park Station after the original site near the Golden Gate Park horseshoe pits was found to be too small and lacking the necessary sight-lines for safety. But according to some residents groups, the parking lot is less safe for youths.

Citing police incident reports, Lena Emmery, president of the Cole Valley Improvement Association, told us the Waller park would be in an area with a high number of reported assaults and drug arrests and would add to noise pollution. “This location puts a skateboard park too close to a dense residential area, as well as some businesses that would be negatively impacted by the noise from the skaters,” she wrote via e-mail.

While the lot is occasionally used for bicycle safety classes and overflow parking at Kezar Stadium, it sits empty most of the year, although a farmers market will hold its grand opening there April 28. Will Keating, a Waller Street resident and skateboarder who works on Haight Street, is excited about the proposed park. He disagrees with claims that the park would be a negative impact on his neighborhood. “I hear homeless mutants going crazy outside my window every night, I would much prefer skateboards,” Keating said of the current noise pollution.

The Haight Ashbury Improvement Association, which is leading the charge for a sit-lie ordinance, conducted a survey on its Web site and found that many of its visitors feel the skatepark would increase noise and safety problems in the Haight. Visitors to the site also said the lot would be better used as a farmers market. Yet city officials say the two are not mutually exclusive, and early designs for the project are said to include a large public plaza adjacent to the park intended for community events.

“We realize this is going to be a multiuse space,” said Nick Kinsey, property manager for the Recreation and Park Department. “Throughout San Francisco there are thousands and thousands of skateboarders but only two places where it is legal to skate.” Kinsey called the park is “a done deal,” citing a 2007 ordinance introduced by Sup. Ross Mirkarimi that mandates the department build a skatepark on the cul-de-sac.

Kent Uyehara, merchant chair for the HAIA and owner of FTC skateshop on Haight, said the community’s fears about pedestrian safety are understandable, but that fears of increased violence and drug use are irrational. “If you can’t have a skate park next to a police station, then basically you are saying you can’t have it.”

If the city enacts the sit-lie ordinance, which Uyehara supports, it would be easy to imagine that a skate park would be a magnet for homeless and others looking to escape police harassment. But Uyehara is adamant that the park would not become a haven for Haight Street refugees. “Skateboarders self-police their own areas,” he said. “We’re not trying to kick the homeless out,” he added. “We’re trying to make the neighborhood attractive for everyone, whether they’re buying something or not.”

Uyehara is no stranger to opposition. When his shop first moved to the Haight in 1994, he had to deal with threats from residents and a neighborhood organization, similar to the one he is now a part of, because of what skateboarding represented to them. Since then skateboarding and his business have prospered, and FTC now has four locations worldwide. “For a city that hosted the X-Games, it’s pathetic how skateboarding has been treated.”

Uyehara says the Waller park, along with the Central Freeway and Potrero del Sol parks, are part of a plan developed by the San Francisco Skate Task Force, created in 2002 by then-Sup. Gavin Newsom to address the growing friction between the city and its skateboard population. The task force envisioned “a series of five parks located in a star pattern, and one in the middle of the city, [that] would make it possible for users to easily get to a park within at least two miles of their home.”

All the meetings and fundraising will be in vain if the park is poorly designed and built, said Jake Phelps, editor-in-chief of Thrasher Magazine. He says locals should design the park “so we have no one to blame but ourselves,” and avoid another flawed park like Crocker Amazon in Sunnydale where, he says, “the fence costs more than the skatepark.” Unimpressed with preliminary designs for the park on Duboce, the notoriously blunt Phelps says, “They’re going to come to our town, drop a turd, and leave.”

The veteran skater is wary of “landscape designers” with grandiose ideas. “There are people who get too involved. They don’t skate. Who are they to tell anybody what it is?” Newer skateparks are too crowded with obstacles trying to please all different kinds of skaters, he said. Instead, he urges a simple design similar to the streets of downtown. “The whole idea of skating is being utilitarian with your environment.” Regardless of the design, he believes it won’t have a dramatic effect on the Haight community: “Homeless people are gonna sleep there,” he said. “People are gonna tag on it and think it’s theirs.”

“The whole city’s a park, but people need somewhere to go when they get kicked out of everywhere,” says pro skater Tony Trujillo, who is able to skate to the Potrero park from his house and thinks others should have the same proximity to hassle-free skating. Julien Stranger, another local pro, feels a park in the Haight would benefit youth in the area by giving them a healthy, creative outlet, something the Haight symbolizes to many. “I don’t think that the neighborhood should be complaining about the energy a skate park will bring,” he said. “Skate parks are pretty positive.”

Earlier this month, an informational meeting hosted by the Haight Ashbury Neighborhood Council, Kinsey, Hornbeck, and other residents raised concerns that noise pollution and property damage would increase because of the skate park. “There’s been no public outreach,” said Martha Hoffman, who lives across from where the park is slated to be built. “If we’d known about it sooner, we would have opposed earlier.”

Thuy Nguyen of the SF Skate Club, an after-school program that promotes skateboarding as a safe and positive activity, urged residents to look beyond their property values and consider the benefits for the city’s youth. “It’s important for kids who feel that traditional sports aren’t for them.” Her partner, Shawn Connolly, added that skateboarding has grown in popularity with children. “It’s right after baseball,” he said.

“If the city doesn’t have a skatepark, the city is the skatepark,” Hornbeck said of the Waller Street lot where he often hosts skate events with donated ramps to ease the community into the idea of skateboarders using the area. But until the city budget can provide for skateboarders, the debate over the park will rage — and the underused parking lot at the end of Waller will remain just that.

SF’s Tax Day protests: Progressives 300, Teabaggers 4

For all the hype about Tax Day Tea Parties, include two in San Francisco this afternoon, it was progressive causes that put the most protesters on the streets today. In fact, at a 1 p.m. Tea Party outside City Hall, the teabaggers were way outnumbered by journalists and satirical “teabaggers” doing street theater.

For awhile, 70-year-old Al Anolik – clad in his American flag shirt and NRA hat – was the only teabagger present, although he was joined by 23-year-old Odell Howard (wearing his American flag on his hat) at about 1:20 p.m. Another pair arrived later, making it four in all.

“It is San Francisco,” Anolik offered by way of explaining the anemic gathering.

Contrast that with two other rallies going on at the same time: Service Employees International Union fielding about 200 protesters on Mission Street near the federal building demanding immigration reform and respect for immigrants, and about 100 people who turned out for the Mobilization for Climate Justice, protesting a conference on carbon offsets.

“Nobody should be given credit for creating greenhouse gas emissions,” Ana Orozco, an organizer for Communities for a Better Environment, Richmond, told the gathering.

CBE was one of several groups demonstrating on Fourth Street outside the Marriott, which was hosting New Direction for Climate Action, put on by Navigating the American Carbon World, a group that promotes a cap-and-trade market for pollution credits.

The protesters said that system would only legitimize pollution and delay the strong actions needed to avert the worst impacts of global warming. “Keep the cap, nix the trade,” the group chanted at one point.

I asked one conference attendee (who wouldn’t give his name) what he thought of the protesters and he called them, “watermelons – green on the outside and red on the inside.” Longtime progressive activist Chris Carlsson said accusing someone of being a communist has always been tactic capitalists use to shut down real debate on important issues.

Anolik and Howard were also quick to play the red card, accusing the Obama administration of plotting to take away people’s guns and instituting a government takeover of the health care system, and neither would listen to arguments that their claims were demonstrably false.

But the progressives on the street today were all about sparking debate, including two members of the Raging Grannies that were at the climate event and then headed over to the Tea Party, where they satirically advocated for a health care system run by wealthy corporations.

“Billionaires for Wealthcare,” was the sign one held, while the other’s read, “Blue Cross, Palin, 2012,” advocating that we cut out the middle man and elect Blue Cross as the next president, with Sarah Palin as its running mate.

And then they broke into the song “We shall overcome,” but with a modified chorus: “We shall overcharge.”
