Chevron hit by lawsuit and mass march on anniversary of refinery blaze

Almost exactly a year ago, an explosion and chemical fire at Chevron’s Richmond refinery sent a toxic plume of smoke billowing into the air. Visible for miles, the blaze sent 15,000 to the hospital with respiratory and other health problems.

On the eve of the anniversary of that disaster, Chevron faces mounting pressure from all sides as everyone from city officials to environmentalists continue to seek accountability.

On Aug. 2, Richmond city officials held a press conference to announce that the city is suing the multinational oil giant for damages related to the refinery fire. Richmond Mayor Gayle McLaughlin joined other officials and representatives from the firm Cotchett, Pitre & McCarthy in announcing the legal action, which was unanimously approved by City Council.

The complaint charges that Chevron’s failure to address safety issues at the plant is reflective of a deeper problem.

“In our view, the incident on Aug. 6, 2012 was not an isolated incident – it really is one that followed a period of dozens of prior incidents” of harmful chemical releases, attorney Frank Pitre told the Guardian. “These aren’t coincidences, they’re indicative of a problem of corporate culture at Chevron that ignores safety.”

Pitre added that the very year that Chevron’s refinery blaze occurred, it recorded record profits with the Securities and Exchange Commission exceeding $26 billion, and its top executives were paid around $100 million apiece. Additionally, the company recorded about $10 million in spending on political campaigns and lobbying. Meanwhile, Chevron’s spending on City Council races in Richmond alone hovers at around $1 million, according to local activists.

The lawyer refused to speculate on how much Richmond plans to seek in damages, but noted that the city had been impacted by factors like mounting an emergency response to the blaze as well as “intangibles,” like the effect the incident had on the comfortable use and enjoyment of public spaces. “You had people who had to run into their homes, as if they were imprisoned.”

Pitre also said that the suit aims to correct Chevron’s lax attitude toward safety, and to “send a very loud and clear message into the corporate board room that they have to change their behavior.”

That message is also coming from grassroots organizations.

On Saturday, Aug. 3 at 10 a.m., activists with a broad coalition of Bay Area environmental and labor organizations will converge in Richmond for a march and rally to call on Chevron to improve its safety practices.

The event, which is expected to draw quite a crowd, is part of 350.org’s national Summer Heat campaign, which seeks to foster climate change activism at the local level. The march will by led by Idle No More, an indigenous rights organization, and organizers have hinted that there will be some form of civil disobedience at the refinery.

Andres Soto, a Richmond organizer with the environmental justice organization Communities for a Better Environment, explained that the safety issues at the refinery stem from Chevron’s failure to address pipe corrosion, which is worsened by the practice of refining dirty crude oil with high sulfur content. Roughly 80 percent of the crude that is processed in Richmond originates in the Persian Gulf, Soto said, and contains high levels of sulfur.

Refining this type of crude oil can result in worse air pollution, and also makes it harder for the company to predict the degree of corrosion that will result from processing.

“The blast on Aug. 6, 2012 was caused by a failed carbon steel pipe,” Soto explained. A report issued by the federal Chemical and Safety Board contained urgent recommendations directing the company to use pipes that are more resistant to corrosion, Soto said, but not all of those recommendations have been implemented, even after the failed unit was brought back into service.

The safety board report went into great detail about just how bad things were allowed to get before the blast occurred. “The 52-inch component where the rupture occurred had experienced extreme thinning,” the safety board found. “The average wall thickness near the rupture location was approximately 40 percent thinner than a dime.” (A dime.)

Soto regards this level of deterioration as par for the course at Chevron. “It’s about a management culture that allows the equipment to fail,” he told the Guardian. “They’re just waiting until the pipes fail, and then they’re going to replace them.”

Now age 73, Stewart is battling cancer behind bars and has petitioned the Federal Bureau of Prisons for compassionate release. The request has been denied, and so supporters are rallying to show their support for Stewart.

When setting up an interview with Jello Biafra, I got this light-hearted warning: “There is no such thing as a short interview with Jello.” It’s true, the legendary punk showman/spoken word enthusiast is full of political ideas, historical references, and elder-punk-dude tales. How can he be expected to keep it brief?

Below, we spend an intense half hour discussing the media, corruption, spoken word, Jello Biafra and the Guantanamo School of Medicine, Jello Biafra and the New Orleans Raunch and Soul All-Stars, and the future of underground rock’n’roll. Where do you gather your news? What are your sources for political commentary in your songs?

Jello Biafra Why, the Bay Guardian, of course! Where would a local voter be without your fine rag? I just hope the new ownership and staff goes pedal to the metal to keep up the standard of muckraking and ethics. There’s so much corruption to dig up in this area.

I think the real renaissance was before the Weekly was sold to New Times/VVM, when the Guardian and the Weekly were both muckraking papers concentrating on local issues and were trying to out-scoop each other. That’s what I’d like to see continue and come back.

But basically I’d read a lot of periodicals. Locally, we have you folks, among others. And then you know Nation, Progressive, Mother Jones, interesting things people send me in the mail, digitally or otherwise, talking to people, putting two and two together — trying to write songs about stuff that no one else has! Or at least not in the same way.

SFBG Why is that? Why choose to write songs about something no one else has?

JB It’s just filling in the gaps with what’s interesting. I’m proud that no two of my music albums sound alike. Not even the Lard albums sound alike. From Dead Kennedys onward my mission as the main lyricist and composer of the damn tunes, I kind of stick to my punk core — whether I intend to or not, it’s just who and what I am — and but kind of widen the base of the pyramid to what you can do with that energy.

SFBG What are some the topics you focused on when writing White People and the Damage Done?

JB I guess it was a little more focused as a semi-concept album, than anything since Frankenchrist. It’s basically about grand theft austerity, and how unnecessary it is, what a scam it is. People have asked me when we go to play different cities or countries, what I think is the biggest problem in the world today and they expect me to say something like “climate change” which I prefer to call “climate collapse” because that’s what it is, or inequality, or war, or whatever, and I say you know, there’s a worse one, it’s corruption. Because that is what’s blocking anything constructive being done about all the other problems. There’s a thread through White People and the Damage Done about that. 

The title track is not so much about race specifically, but about this attitude of the higher ups in the United States, the EU, and others, is that other countries, especially ones run by people of color, where we call them “Third World” or whatever, are somehow unfit to govern themselves and need us to pull the strings, plant the puppets, and tell everyone what to do. And it’s often for the purposes of looting their resources and exploiting their people. And what kind of unintended consequences that can have.

For example, we talk about why we need more democracy in Iran, and we don’t have the big bad Soviet Empire to freak out everyone anymore so we have Iran and North Korea instead. Wait a minute, you want democracy in the Middle East? Well Iran was a democracy in the early 1950s, guess who decided to overthrow the democratically-elected leader Mohammad Mosaddegh, and put the most hated person in the country, the Shah, back into power? But he was our policeman for the gulf basically, and he got overthrown anyway. And now it’s a theocratic regime. Where would be today if we had just left that region alone in the 1950s?

Same for Afghanistan. I nearly went through the roof when I found out about an interview with Jimmy Carter’s old national security advisor, Zbigniew Brzezinski’s, whose daughter is on one of the morning cartoon pundit shows, bragged on an interview with French media about what a great thing we did by arming, training, and financing the guerrillas in Afghanistan before the Soviet Union invaded, and how we cracked apart the evil empire, hooray for us, we win.

But look what we created for crying out loud. We were even helping back a young hothead with a trust fund named Osama Bin Laden. And then once the Soviets were out, we didn’t lift a finger to help rebuild the country, let alone take back the guns and rocket-launchers. And now look where we are. That’s another example of white people and the damage done.

[Pause] hold on my juice machine, now I have to turn it off, it’s bouncing all over the counter.

SFBG What kind of juice are you making?

JB Oh, just a mixture of stuff. Spinach, apples, other things.

SFBG Can you tell me about forming Guantanamo School of Medicine?

JB Here we go again. I wanted to have another band ever since Dead Kennedys, it just never quite happened. Either people weren’t available, or I was off doing spoken word or other adventures, but of course I never stopped making albums, there was Lard, two with the Melvins, one with DOA, Mojo Nixon, NoMeansNo.

I kept the music out there, I just didn’t have a performing vehicle. And then when I was down at the Warfield seeing the Stooges on Iggy’s 60th birthday, it occurred to me, “oh shit, I turn 50 next year. I better do something or I may never get another chance.” If it’s half as good as the Stooges, I’ll declare victory.

SFBG Do you have any other projects coming up?

JB I started getting back into spoken word. I did a tour in Australia after the band’s tour was done. And at some point, something that will probably see the light of day: some of the New Orleans guys from Cowboy Mouse and Dash Rip Rock dared me to come down there during the jazz fest a few years ago and do a whole set of New Orleans soul and rhythm and blues songs, which I did with some badly needed garage rock added in and we got Mojo Nixon’s keyboard wizard with all the Jerry Lee Lewis moves, and quite the cacophonous horn section, as well as [Cowboy Mouth’s] Fred LeBlanc, and [Dash Rip Rock’s] Bill Davis.

The multitrack recording was a trainwreck, but then Ben Mumphrey who works with Frank Black and the Pixies and many others, called me up and said he could rescue this recording. Slowly but surely he has been rescuing it. So Jello Biafra and the New Orleans Raunch and Soul All-Stars will see the light of day somehow. We haven’t been able to pull it together to play a show though.

SFBG I was wondering your opinion of this new, kind of second tech bubble taking over in areas like the Mission?

JB Again, I refer you to one of my songs. It came out on the EP of the rest of the recording session when we recorded The Audacity of Hype with Billy Gould. The song is called “Dot Com Monte Carlo.” And sure enough there was a little mini firestorm on the Internet of course. A lot of people writing in were too chicken-shit to sign their own names, but they said ‘oh that’s such an old topic, it doesn’t matter anymore.’

Well I had this funny feeling we weren’t done with the Dot Com Holocaust. Sure enough, now it’s more aggressive and obnoxious than ever. Dot Com Monte Carlo — that’s kind of what Willie Brown’s puppets are trying to turn this city into, yet again.

It has been really sad for me to see so many cool people and artists and service-workers and people of color just bull-dozed out of this town to make room for more mini little yuppies who treat San Francisco as a suburb of Silly-clone Valley.

And now you don’t see people like me when I was 19, just moving out to San Francisco chasing a dream. There was a time when the vitality of the underground was maintained by entire bands moving here as a unit. Everybody from MDC and the Dicks to DRI and later, Zen Guerilla, the only one I can think of in recent years, who dare tried to relocate to San Francisco were I believe No Doctors and Sixteen Bitch Pile-Up, and I’m not sure either one of them exist at this point. Maybe they all packed up and left. A lot of that underground fire, and that’s not just confined to rock of course, but a lot is going on in Oakland now.

SFBG Yeah, I’ve had a lot of bands telling me they can’t afford San Francisco anymore, so they’ve been moving to the East Bay or beyond…

JB I mean, I’d hate to see San Francisco turn any further into a giant Aspen, Colorado, or even Boulder, Colorado, which is where I fled from in order to come here [in ’78.]

SFBG Are there current East Bay or San Francisco bands that you feel like are doing good things?

JB Of course I always brain-fart on this question. Well, of course I’m going to support my label bands, I love Pins of Light.

SFBG How involved are you with Alternative Tentacles? Are you going out and finding bands?

JB Well I’m still the absentee-thought-lord, the buck stops with me. Someone deeply suspicious of capitalism has wound up owning a business by default, whether I should or not. Luckily there’s still money to pay a shrinking staff and to make sure we can keep putting out cool things. But it’s becoming harder and harder because of the combination of a crashed economy, rents going through the ceiling all over country, and file-sharing on the other hand. Of course, one feeds the other when people don’t have any money.

That doesn’t mean I support these misguided efforts, these major label RIAA scams to blackmail people and sue them for file-sharing. They’ve raked in over a hundred million dollars doing that and no artist has seen a penny. That’s not the way to solve this.

On the other hand, when I see one of the best bands we’ve seen in years like the Phantom Limbs break up way too soon, I can’t help but wonder whether file-sharing might be a part of the problem, with so many people going crazy over them and going to their shows all over the place, and then hardly anybody buys the album.

When you’ve got people in the age of high housing and transportation cost trying to keep themselves fed or also sustain a family, that hurts. I wonder how many people save up money from their shitty jobs for years in order to make some really cool piece of music only to find that nobody actually gives anything back; they’re that much more likely to quit making anything.

Maybe the solution is, for people who want to get their friends into really cool music, don’t just send them the whole album, pick some favorites and send them a little teaser package, a little file to inspire them to check out them more.

Not to mention, be conscious of whose file you’re sharing. Major labels go so far out of their way to rip off their artists anyways, with an army of lawyers to back them up. But when it’s an underground artist or label, that’s different. I never would have thought that GSL would’ve stopped, for example. Or that Touch and Go would draw mainly into reissues and back catalogue. It’s not just the economy and music industry crashed that’s to blame, it’s also people who don’t think artists should get any of their support.

SFBG Do you still love performing in front of a crowd? Do you have any recent performances with this band that you’ll take with you?

JB I’m not sure I’d be doing it if there wasn’t this inner need to do it. I’m really greatful that at my age anybody even cares about what I have to say, or new stuff I’ve been making.

We’ve been able to play a lot of places Dead Kennedys weren’t, because countries hadn’t opened up yet and they were still under the boot of Communist dictators or Latin American military or whatever. And we get to play for people in those places now. I don’t have the kind money where I can go jet-setting around to these places, I have to play my way to places like Buenos Aires or Slovenia, or I’ll never get there.

Bringing these musical riffs in my head to life and to have them actually work and getting to play them for people, that’s always pretty cool.

Some of the stranger moments were last time we were in Geneva we had a stage-diver in a wheelchair. The crowd was very gentle with him, passing him around, and making sure he was reunited with the chair, which was floating somewhere else in the crowd. Three or four songs later, he’d be back again! That was good.

Also, being able to scrape together just enough of my high school Spanish to be able to talk to people in Buenos Aires from the stage about some songs that were written with them in mind. I mean, “Bleed for Me,” the old Dead Kennedys song, was written about the Dirty Wars. And this was the first time I could actually dedicate “Bleed for Me” to the Desaparecidos in Argentina and explain it a little bit.

TOFU AND WHISKEY Jello Biafra could be your theatrical political science professor. The still-charismatic frontperson and song-composer has long spewed knowledge deep from the underbelly of political theater, from his influential early 1980s Bay Area punk band Dead Kennedys, and projects like the band Lard, through his nine dense spoken word albums, and up to his newest musical endeavor, louder than ever in his 50s, Jello Biafra and the Guantanamo School of Medicine.

That band, which also includes Victims Family guitarist Ralph Spight, plays the Uptown this weekend with D.I., the Divvys, and Gir-illa Biscuits — an excellent local Gorilla Biscuits tribute act (Fri/26, 9pm, $15. Uptown, 1928 Telegraph, Oakl. www.uptownnightclub.com.)

Given Biafra’s affinity for weaving news-worthy (though oft-overlooked) scandals into contextual lyrics, I have often wondered from where he gathered his news. “Why, the Bay Guardian, of course! Where would a local voter be without your fine rag?” Biafra tells me from his San Francisco home, while finishing up making a juice of apples and greens. Is he mocking me? “I just hope the new ownership and staff goes pedal to the metal to keep up the standard of muckraking and ethics. There’s so much corruption to dig up in this area.” No, his tone is just often sarcastic.

Guantanamo School of Medicine’s White People and the Damage Done (Alternative Tentacles, 2013) is the group’s most recent album. A semi-concept album, Biafra says it’s about “grand theft austerity, and how unnecessary it is.”

He explains, “People have asked me…what I think is the biggest problem in the world today and they expect me to say something like ‘climate change’… or inequality, or war, or whatever. I say you know, there’s a worse one, it’s corruption. Because that is what’s blocking anything constructive from being done about all those other problems.”

The title track of White People and the Damage Done, a pounding, guitar-heavy, Dead Kennedys-esque song, explicitly points a finger toward attitudes of the higher-ups in the US and EU regarding countries run by people of color, and the need to step in and take control.

Anthemic single “Shock-U-Py!” has a chantable chorus, and moment-in-time impact. In it, Biafra howls “Wake up and smell the noise/We can’t take it any more/Corporate coup must go/We will Occupy/We will Shock-U-py.” The Occupy movement may have left the mainstream radar for now, but Biafra’s song commemorated the moment, much like he did in early career chants calling out yuppies and atrocities in places like Cambodia, in the early ’80s. His lyrics are typically both rooted in the present, and packed with historical references.

A fast-paced earlier released track (still with that Biafra-esque carnivalian breakdown), “Dot Com Holocaust,” recorded at the time of the The Audacity of Hype EP (AT, 2009), touched on problems more local to Biafra and this rag, of gentrification and a new class of tasteless techies coming in to the Bay. Dripping with satire, the song seemed to have touched a nerve when first released, and garnered scores of angry, faceless Internet comments.

When we discuss newer bands, he notes many acts are fleeing SF for the East Bay, something bands across genre styles and influences have brought up with me during casual conversations and interviews.

“Now you don’t see people like me when I was 19, just moving out to San Francisco [from Boulder, Colo.], chasing a dream. There was a time when the vitality of the underground was maintained by entire bands moving here as a unit. Everybody from MDC and the Dicks to DRI and later, Zen Guerilla.”

But as an underground label owner (Alternative Tentacles) he knows times are tough for both bands and music fans, with a poisonous combination of the crashed economy and rampant file-sharing affecting all involved. “I wonder how many people save up money from their shitty jobs for years in order to make some really cool piece of music only to find that nobody actually gives anything back,” he says. “Maybe the solution for people who want to get their friends into really cool music, don’t just send them the whole album, pick some favorites and send them a little teaser package, a little file to inspire them to check out them more.”

YASSOU BENEDICT

Counterpoint, there are still some bands and artist types heading way out west to San Francisco in these turbulent, high-priced times: Yassou Benedict. This band is not in the slightest akin to Biafra’s people, though it is a group of hopeful young dreamers.

The shoegazing dreampop four-piece formed at a small high school in Upstate New York. While most bands from the area would migrate south to New York City, Yassou Benedict made the “fairly random” decision to head to SF. “We all got into a Subaru Forrester with a Great Dane in the back and all our stuff in a trailer and drove across country,” says guitarist James Jackson, who traveled with singer-bassist Lilie Bytheway-Hoy, guitarist-keyboardist A.J. Krumholz, and drummer Patrick Aguirre.

Now in the Bay, they work as servers at Outerlands, a cook at Beauty Bagels and Wise Sons, a bartender at the Boxing Room, and a pizza-dealer at Lanesplitter Pizza and Pub.

But more importantly, the group of 20-somethings recently released its debut EP, In Fits in Dreams, a moody, complex, emotionally fraught record that leaves the listener itching for a full-length, and touches on themes of “anxiety, and wanting to be weightless, the desire to run through wide open spaces.” The album release party was actually a few weeks back, but you can catch the band this week at Milk Bar with Beautiful Machines, Hotel Eden, and NVO (Fri/26, 8:30pm, $10. Milk Bar, 1840 Haight, SF. www.milksf.com).

Led by Bytheway-Hoy’s dramatic, high-ranging vocals, and unconventional song structures (like shifting time signatures) In Fits in Dreams also features guest vocals by Hole’s Melissa Auf Der Maur on track “Cloisters.”

The subtle beats and rolling vocals of “Cloisters” feels like a doomed march toward the unknown, while closer “Last Cicada” ventures more into Radiohead In Rainbows territory (the band has been known to cover “Jigsaw Falling Into Place”). There’s also the church-like pop hymn of “Back Roads that Dead End,” which begins as an anxious vocal solo with faraway chimes, the beats and guitars slowing filtering in.

It’s surely been noted elsewhere on the blogosphere, but there’s something strangely seductive within Yassou Benedict, which I mention to Jackson. “I am not sure why that is. If we are making people feel, whether it is the desire to make love, or children or anything else, than we are succeeding. It is kind of strange though. Our music is fairly depressing. Now I’m just imaging people holding each other and crying while they listen. Lilie’s voice probably has a lot to do with that.” Bytheway-Hoy’s voice is indeed both haunting and captivating.

There’s also a cinematic quality to In Fits in Dreams, likely driven by that high emotional tug. Given the soundtrack capabilities, I asked Jackson what type of film would best be suited to Yassou Benedict and he picked a future Wes Anderson film, also noting that a dream opening slot would be an imaginary Radiohead show in an intimate venue (no arenas!).

While the record was recorded and produced back in Hudson, NY (with Steve Durand at Dioramaland Studios), the band is touring on it from its new homebase in the Bay.

Disillusionment, “Everyman,” and Netroots Nation

For nearly the entire Caltrain ride to down San Jose last Thursday morning, my thoughts were fully consumed by the subject of liberal disillusionment and cynicism. I pondered the question, “How much progress have the things that liberals care about made since the start of the new millennium?”

The issue of gay rights was the only glimmer of hope I could conjure up. Since 2000, income inequality has increased astronomically, the military-industrial complex grows unabated, the drug war continues to destroy millions of lives, women are having to protest the same idiotic conservatives policies their mothers protested, we are realizing the tangible repercussions of climate change, the Citizens United ruling and Republicans have become the John Birch Party and Democrats, by and large, have become identical to the Republicans of 30 years ago.

And while it may be true that progressives were responsible for electing the first black president, the Obama Administration has, for the most part, ignored, shunned, and at times insulted progressives. If Obama governed like a progressive, he would have jailed Wall Street executives for their roles in the financial crisis and HSBC bankers for laundering terrorist and drug cartel money, he would have rejected the Keystone pipeline in resounding fashion, he would have fought harder for a public option, he would have ended or at least decreased the surveillance state, and he wouldn’t be prosecuting medical pot dispensaries with extreme vigor.

Like a lot of the other media there, I came in search of demoralized liberals and to see if the Democratic Party leaders and other notable figures in attendance would feel the brunt of this dismay.

Unsurprisingly, the boogeyman of John Boehner, the Koch Brothers, and other rightwing caricatures were paraded out in order to stomp out any reservations you may have had about the president. One of the most notable lines of the conference was Howard Dean’s unfunny salvo of how the president isn’t perfect, “but it sure beats having Bain Capital, oops, I mean Mitt Romney in the White House!”

When our Rep. Nancy Pelosi was booed for saying that Edward Snowden should be prosecuted for his leaks, she tried shouting over the jeers by repeatedly saying that Obama’s second term was not Bush’s fourth. Then she tried to calm the crowd down (in a twist of irony, a man named Marc Peckel was kicked out for voicing objection to a police state), saying she welcomed the booing and debate about privacy. But would we be having this debate now, if it weren’t for Snowden’s leaks?

I attempted to ask Rep. Pelosi some follow-up questions as she exited the building (flanked by numerous aides and security) but oddly enough, my shouts of “I’m with the San Francisco Bay Guardian!” didn’t faze her one bit.

From the dozens of interviews I conducted with a wide range of attendees, the overall consensus seemed to be that Obama, his administration and other Democratic Party leaders are still on their side – though a good number of my interviewees expressed profound disappointment that the president hasn’t been liberal enough. One healthcare organizer from Chicago said he was immensely dissatisfied by Obamacare, but believes that it’s right the step toward implementing universal healthcare.

Obama’s most visible critic for the three days was a man who goes by the name Stan Everyman, who came on behalf of the San Jose Peace & Justice Center and carried a sign everywhere he went that read “OBAMA=CHENEY”. Everyman, who fervently believes that “Netroots is firmly under control of the Democratic party,” saw the conference as an opportunity to connect with other progressives who have gripes with Obama. The majority of reactions to his sign were positive, he said, but he did wind up engaging in some mild confrontations with what he calls “Democrat loyalists.” He was aghast when he encountered someone who came to Netroots on behalf of a liberal dating service, saying, “she didn’t mind if her emails and calls were tapped and didn’t care if there were helicopters hovering over her house as long as it caught the terrorists.” and when it did elicit a reaction, did nothing more than get a thumbs up or an eye-roll.

Meanwhile, some Democratic figures urged progressives to pressure elected leaders as much as possible. Keith Ellison, a Minnesota representative and co-chair of the progressive caucus, stated: “If people who came before us got discouraged because things were hard, we’d still have slavery, have no right to collective bargaining, the air quality would be horrible. The problem isn’t that you’re not involved and you didn’t get what you wanted, the problem is that you got to stay involved.”

When I countered that a big reason behind liberal disillusionment was that our own guy didn’t come through for us, Ellison’s responded, “Let me say this, never ever organize around a personality – even if it’s an awesome personality like Obama’s. Organize around the principles that guide you. Somewhere along the way we stopped saying ‘yes we can’ and started saying ‘yes he can,’ and when he didn’t do certain things we want, we got discouraged. What personality does the Tea Party coalesce around? None! They coalesce around, ‘we hate government, we love guns’ and ‘if you’re not quite like us, you’re not all right.’ So the progressive movement should coalesce around generosity, inclusion, fairness, sustainability, and leaders need to live up to that, and if they do, they’re good, and if they don’t, they’re not. But it shouldn’t be a personality-driven thing.”

If you want change, you have to keep on keeping on, no matter. Sure, town halls, letter campaigns, and protests are great ways to engage your politicians and in democracy, but when you got to go to work or tend to your family, six-figure lobbyists walk through the halls of Congress retracting whatever impact the people’s efforts made. Politicians want us to give them the political will to do what’s right even though we elected them to do what’s right. I don’t naively believe politicians are perfect and that they’re our friends and that we can sit back and relax after we pull the voting lever. However I do have a problem with “I’ll fight for you!” during the campaign season and “Fight for me!” during the legislative sessions. The latter due to this being a non-election year, was the unofficial theme of Netroots Nation 2013, which also possessed a palpable feeling that the reason why many of the big names showed up was to throw the progressive wing a bone and quell whatever qualms they have.

I do admit that Netroots, in the past, has resulted in a concrete impact (namely, helping to get Obama elected and being instrumental in manufacturing a 21st century online campaign apparatus). However, the chances that it will be able to pull Hillary Clinton—who’s just as hawkish as Dianne Feinstein— to the left beyond the duration of the conference are lower than the probability of Obama appointing Angela Davis as his Chief of Staff. A piece on Salon.com a couple days ago reported that progressives are open to a Clinton run, which should come as no surprise to given how good the left is at reconciling their beliefs with that of their leaders.

So between now and NN14 (which is in Detroit), when the Democratic Leadership will come begging for the left’s help to return the Speakership crown back to Pelosi, pretty much everything the left holds dear will wallow in purgatory or regress to hell. But cheer up: At least Bain Capital isn’t president!

Netroots Nation: How to make a comeback

At Netroots Nation the central focus on the how, and not so much the why. Everyone here knows why austerity is devastating, why women need ready access to birth control, and why blank-industrial complex is morally reprehensible. But not everyone necessarily knows how marriage equality made a comeback in 2012, or how one goes about convincing your Nebraska Republican farmer father to believe in climate change. At Netroots, your network is your net worth. 

A noteworthy panel of the day was “Moving the Needle: How We Won the Gay Marriage Fight,” spotlighting an issue where the left has made considerable progress. Remember the days when Feinstein was trying to stop Newsom from issuing gay marriage licenses? That was less than a decade ago; today, even Republican senators from Alaska endorse gay marriage.

In 2009, the pro-gay marriage team lost at the ballot by 33,000 votes, three years later the good guys won by 38,000. Ian Grady, communications director for Equality Maine, explained “that their main message of ‘equal rights for all’” lacked the emotional resonance to persuade swing voters and “left the LGBT community vulnerable to the civil unions argument.” In 2012 when Equality Maine pivoted to showcasing a marine talking about his two moms and a grandfather’s emotional speech about wanting to see his granddaughter get married, their research overwhelmingly showed that the impact of emotional persuasion. PR pro tip for liberals and progressives: evaluate and reevaluate ideas that look like no-brainers to you and know that style (communication) is just about as important as substance (ideas).

Closing out the first day was the pep rally! Liberal stalwarts Howard Dean and Barney Frank, activist Sandra Fluke, Speaker of the California House John Perez, Senator Jeff Merkeley, and a video appearance from Obama all reiterated the message, and provided a much-needed respite from the dysfunctional state of our government by reminding us of the progress our issues have made and inspired us to keep on keeping on.

Guardian forum on Plan Bay Area draws big, engaged crowd

San Franciscans who want to help shape how this city grows — rather than just leaving it up to regional planners and market forces — packed a large conference room last night for a community forum presented by the Bay Guardian: “Whose Future? What Does the Regional ‘Plan Bay Area’ Really Mean for San Francisco?”

Moderated and organized by Guardian Editor/Publisher Tim Redmond, and co-sponsored by the Council of Community Housing Organizations (CCHO) and Urban Institute for Development and Economic Alternatives (UrbanIDEA), the session began with a overview of what’s now being planned for the San Francisco of 2040.

Gen Fujoika of the Chinatown Community Development Center said that Plan Bay Area, which is being jointly developed by the Association of Bay Area Governments and Metropolitan Transportation Commission (which will hold a hearing on the plan tomorrow, Fri/14, at 9:30am in Oakland), doesn’t pay for itself yet it will include strong incentives that will shape development in the region.

“It is in some sense a plan and I think we need to critique the hell out of that plan,” he said. “As we think of Plan Bay Area as a vision statement, we need to think about whether it’s our vision.”

As illustrated by the Plan Bay Area maps that the lined the walls of the LGBT Center conference room, the plan’s “priority development areas” that are slated for dense, streamlined development are also the same areas identified as “communities of concern” with vulnerable, low-income populations, making the plan a recipe for mass displacement.

Fujoika quoted a comment that Mayor Ed Lee made on Tuesday when asked by Sup. Eric Mar about the issue: “San Francisco has some of the toughest anti-displacements laws in the country.” While that may be true, Fujoika said that the plummeting numbers of African-Americans in the city and Plan Bay Area’s displacement projections for San Francisco show those laws simply aren’t up the challenge.

“If we have the toughest anti-displacement position in the country, then we are in some trouble,” he said, calculating that the affordable housing needed to prevent extreme gentrification in the city would total $6.8 billion, and that the affordable housing fund created by voters last year is only projected to raise $1.3 billion by 2030.

Fujoika said that he and the other panelists aren’t against growth and development, “but we are for equitable growth,” which would involve more community buy-in for the plan, more money for affordable housing and infrastructure needs, and more of the growth burden being shared by other Bay Area communities.

San Francisco Planning Commission Chair Cindy Wu cited growth projections for Chinatown as a good example of the problem, noting that is already a dense, complete neighborhood that would suffer from the greatly increased traffic that would be funneled through it and other negative impacts of unfettered growth.

“It’s not just growth for growth’s sake, it’s who gets to live there and who gets those jobs,” she said. Wu called for more community organizing around this and other development plans, citing as a good example the coalition-building that forced California Pacific Medical Center to agree to a multi-hospital project with far better community benefits than the deal it originally cut with the Mayor’s Office.

It was a point echoed by Maria Zamudio with Causa Justa, who said Plan Bay Area will worsen pressures that are already displacing the Mission District residents she works with, or forcing them to live in unsafe housing. “They’re going to push our families out of the city and maybe out of the region,” she said.

To combat the power that this plan and profit-minded property owners will exert over how San Francisco grows, San Francisco Labor Council President Mike Casey, head of UNITE-HERE Local 2, said that progressive San Franciscans will need to work cooperatively with organized labor, a relationship that has suffered during these tough economic times.

“Unfortunately, I think we’ve become alienated and marginalized from each other,” Casey said, calling on activists to not let differences over individual projects or issues interfere with solidarity over the larger, longer struggle for equity and justice.

“Not everyone agrees that a strong labor movement is the cornerstone of a more progressive vision,” Casey said, arguing that displacement of working class people from the city has a cascading effect in gentrifying the city. “The demographics of a city shape very much what the politics of protest look like.”

And those politics of protest will be more crucial than ever in resisting the demands that powerful capitalists will make on San Francisco in the coming years, a point that all seven panelists seemed to agree on.

Bob Allen of Urban Habitat said the planning research groups represented on the panel need to find ways to funnel more funding into grassroots organizing, both in San Francisco and regionally. Otherwise, we’ll see the “suburbanization of poverty,” with Plan Bay Area funneling the best jobs and most expensive housing into urban areas and leaving everyone else to fend for themselves in communities that don’t have the tenant protections and other hard-won social justice programs that San Franciscans have struggled for.

“Local control can be a way of saying ‘I don’t want black or brown people to live in my suburban community,” Allen said.

Ironically, Plan Bay Area is ostensibly driven by concerns over climate change and the argument that it’s better to concentrate development along transit corridors, which is why almost all of San Francisco and much of Oakland is proposed for development that would be given waivers from some California Environmental Quality Act scrutiny.

Yet the plan doesn’t fund the transit upgrades that would be needed to serve that growth or create restrictions on automobile use that might encourage more transit use. Instead, Fujoika said low-income people who actually use transit would be the diplaced in favor of wealthier residents who might not.

“Transit has become an amenity rather than a necessity,” Wu said.

The forum, which was attended by more than 130 people, included a lively discussion that involved dozens of audience members who offered their own views, ideas, and strategies for how to move forward. Among them was Brian Basinger of the AIDS Housing Alliance, who said that he is working with a coalition to reform the Ellis Act, which allows landlords to evict tenants from rent-controlled apartments.

“We could move this as early as January,” Basinger said of the reform legislation now being developed with allies in the Legislature, urging attendees to get involved.

After the audience discussion, the meeting closed with Peter Cohen of the CCHO summarizing the high points and getting people to sign up on lists that were circulated to be involved with next steps. And Rachel Brahinsky, a former Guardian staff writer who is now a professor at USF’s Leo T. McCarthy Center for Public Service and the Common Good, urged attendees to fight for San Francisco to remain inclusive and diverse: “San Francisco is the place it is because people have kept fighting.”

Becoming Traviata Philippe Béziat’s backstage doc offers an absorbing look at a particularly innovative production of Verdi’s La Traviata, directed by Jean-François Sivadier and starring the luminous Natalie Dessay (currently appearing in SF Opera‘s production of Tales of Hoffman). Béziat eschews narration or interviews; instead, his camera simply tracks artists at work, moving from rehearsal room to stage as Sivadier and Dessay (along with her co-stars) block scenes, make suggestions, practice gestures, and engage in the hit-and-miss experimentation that defines the creative process. The film is edited so that La Traviata progresses chronologically, with the earliest scenes unfolding on a spartan set (Dessay’s practice attire: yoga clothes), and the tragic climax taking place onstage, with an orchestra in the pit and sparkly make-up in full effect. Dessay will appear in person at San Francisco screenings Sat/15 at 7pm and Sun/16 at 2pm. (1:53) (Cheryl Eddy)

Dirty Wars Subtitled “the world is a battlefield,” this doc follows author and Nation magazine writer Jeremy Scahill as he probes the disturbing underbelly of America’s ongoing counterterrorism campaign. After he gets wind of a deadly nighttime raid on a home in rural Afghanistan, Scahill does his best to investigate what really happened, though what he hears from eyewitnesses doesn’t line up with the military explanation — and nobody from the official side of things cares to discuss it any further, thank you very much. With its talk of cover-ups and covert military units, and interviewees who appear in silhouette with their voices disguised, Dirty Wars plays like a thriller until Osama bin Laden’s death shifts certain (but not all) elements of the story Scahill’s chasing into the mainstream-news spotlight. The journalist makes valid points about how an utter lack of accountability or regard for consequences (that will reverberate for generations to come) means the “war on terror” will never end, but Dirty Wars suffers a bit from too much voice-over. Even the film’s gorgeous cinematography — director Rick Rowley won a prize for it at Sundance earlier this year — can’t alleviate the sensation that Dirty Wars is mostly an illustrated-lecture version of Scahill’s source-material book. Still, it’s a compelling lecture. (1:26) (Cheryl Eddy)

The Guillotines Why yes, that is Jimmy Wang Yu, director and star of 1976 cult classic Master of the Flying Guillotine, in a small but pivotal role commanding a team of assassins who specialize in dispatching heads with airborne versions of you-know-which weapon. Unfortunately, this latest from Andrew Lau (best-known stateside for 2002’s Infernal Affairs, remade into Martin Scorsese’s 2006 Oscar-winner The Departed) doesn’t have nearly as much fun as it should; dudes be chopping heads off in a flurry of CG’d-up steampunky whirlygigs, but The Guillotines‘ tone is possibly even more deadly, as in deadly serious. When a rebellious prophet-folk hero known as Wolf (Xiaoming Huang) runs afoul of the Emperor’s top-secret Guillotine brotherhood, led in the field by Leng (Ethan Juan), the squad travels in disguise to a rural, smallpox-afflicted village to track him down. Along for the journey is the Emperor’s top operative, ruthless Agent Du (Shawn Yue), a boyhood friend of Leng’s. Leng and Du share a dark secret: the Guillotines have been deemed expendable — yep, in the Stallone sense — and the Emperor has decided to kill them off and replace them with armies toting guns and cannons in the name of progress. Lau is no stranger to tales of men grappling with betrayals, misplaced loyalties, and hidden personal agendas — and as historical martial-arts fantasies go, The Guillotines has higher production values than most, with sweeping, luscious photography. Too bad all the action scenes are punctuated by episodes of moody brooding — replete with slo-mo gazing off into the distance, dramatically falling tears, solemn heart-to-hearts, swelling strings, and the occasional howl of anguish. Man of Steel As beloved as he is, Superman is a tough superhero to crack — or otherwise bend into anything resembling a modern character. Director Zack Snyder and writer David S. Goyer, working with producer Christopher Nolan on the initial story, do their best to nuance this reboot, which focuses primarily on Supe’s alien origins and takes its zoom-happy space battles from Battlestar Galactica. The story begins with Kal-El’s birth on a Krypton that’s rapidly going into the shitter: the exploited planet is about to explode and wayward General Zod (Michael Shannon) is staging a coup, killing Kal-El’s father, Jor-El (Russell Crowe), the Kryptonians’ lead scientist, and being conveniently put on ice in order to battle yet another day. That day comes as Kal-El, now a 20-something earthling named Clark Kent (Henry Cavill) — resigned to his status as an outsider, a role dreamed up by his protective adoptive dad (Kevin Costner) — has turned into a bit of a (dharma) bum, looking like a buff Jack Kerouac, working Deadliest Catch-style rigs, and rescuing people along the way to finding himself. Spunky Lois Lane (Amy Adams) is the key to his, erm, coming-out party, necessitated by a certain special someone looking to reboot the Kryptonian race on earth. The greatest danger here lies in the fact that all the leached-of-color quasi-sepia tone action can turn into a bit of a Kryptonian-US Army demolition derby, making for a mess of rubble and tricky-to-parse fight sequences that, of course, will satisfy the fanboys and -girls, but will likely glaze the eyes of many others. Nevertheless, the effort Snyder and crew pack into this lengthy artifact — with its chronology-scrambling flashbacks and multiple platforms for Shannon, Diane Lane, Christopher Meloni, Laurence Fishburne, and the like — pays off on the level of sheer scale, adding up to what feels like the best Superman on film or TV to date — though that bar seems pretty easy to leap over in a single bound. Pandora’s Promise Filmmaker Robert Stone has traveled far from his first film, 1988’s Oscar-nominated anti-nuke Radio Bikini, to today, with the release of Pandora’s Promise, a detailed and guaranteed-to-be-controversial examination of nuclear power and the environmentalists who have transitioned from fervently anti- to pro-nuclear. Interviewing activists and authors like Stewart Brand, Gwyneth Cravens, Mark Lynas, and Michael Shellenberger, among others, Stone eloquently visualizes all angles of their discussion with media, industrial, and newly shot footage, starting with a visit to the largest nuclear disaster of recent years, Fukushima, which he visits with the hazmat-suited environmental activist and journalist Lynas and continuing to Chernobyl and its current denizens. Couching the debate in cultural and political context going back to World War II, Stone builds a case for nuclear energy as a viable method to provide clean, safe power for planet in the throes of climate change that will nonetheless need double or triple the current amount of energy by 2050, as billions in the developing world emerge from poverty. In a practical sense, as The Death of Environmentalism author Shellenberger asserts, “The idea that we’re going to replace oil and coal with solar and wind and nothing else is a hallucinatory delusion.” Stone and his subjects put together an enticing argument to turn to nuclear as a way forward from coal, made compelling by the idea that designs for safer alternative reactors that produce less waste are out there. David Chiu’s flextime

I’m not surprised that the folks at the Chamber of Commerce are all agitated about Sup. David Chiu’s proposal to expand family-friendly scheduling at local businesses. The Chamber’s Jim Lazarus is typically out of control:

“At some point, people are not going to want to create businesses in San Francisco when they have to go up to City Hall for a hearing every time an employee doesn’t like their reason for not agreeing to a shorter workweek,” Lazarus said. “Are we going to close for the month of August like France? Is that the next one?”

For the record, I’m all in favor of the French way of thinking about work. But you already know that.

Here’s the crazy thing, though: The Chiu legislation is actually remarkably mild. All it says is that a worker at a company with more than 10 employees has the right to request a different work schedule. The word here is “request.” The company can deny the request if would “create an undue hardship for the company or organization, including an increase in costs or a detrimental effect on the ability to meet customer or client demands.”

Folks: That’s a huge, broad exemption. If giving an employee the right to work at home sometimes (actually, a good idea for lots of reasons, including climate change) or the right to start or end a shift early or late, costs any money or causes any real disruption in the business, then management is exempt and can deny the request.

All the law would really do is elevate the idea of flextime to something that has to be considered if someone asks for it. And you can’t be fired for asking.

If the Chamber is going to go ballistic about this, it’s way out of step. A lot of businesses in the city already comply with at least the spirit of the Chiu law. I don’t see this as a huge issue for anyone.

OPENING

Becoming Traviata Philippe Béziat’s backstage doc offers an absorbing look at a particularly innovative production of Verdi’s La Traviata, directed by Jean-François Sivadier and starring the luminous Natalie Dessay (currently appearing in SF Opera’s production of Tales of Hoffman). Béziat eschews narration or interviews; instead, his camera simply tracks artists at work, moving from rehearsal room to stage as Sivadier and Dessay (along with her co-stars) block scenes, make suggestions, practice gestures, and engage in the hit-and-miss experimentation that defines the creative process. The film is edited so that La Traviata progresses chronologically, with the earliest scenes unfolding on a spartan set (Dessay’s practice attire: yoga clothes), and the tragic climax taking place onstage, with an orchestra in the pit and sparkly make-up in full effect. Dessay will appear in person at San Francisco screenings Sat/15 at 7pm and Sun/16 at 2pm. (1:53) Opera Plaza, Shattuck, Smith Rafael. (Eddy)

Dirty Wars Subtitled "the world is a battlefield," this doc follows author and Nation magazine writer Jeremy Scahill as he probes the disturbing underbelly of America’s ongoing counterterrorism campaign. After he gets wind of a deadly nighttime raid on a home in rural Afghanistan, Scahill does his best to investigate what really happened, though what he hears from eyewitnesses doesn’t line up with the military explanation — and nobody from the official side of things cares to discuss it any further, thank you very much. With its talk of cover-ups and covert military units, and interviewees who appear in silhouette with their voices disguised, Dirty Wars plays like a thriller until Osama bin Laden’s death shifts certain (but not all) elements of the story Scahill’s chasing into the mainstream-news spotlight. The journalist makes valid points about how an utter lack of accountability or regard for consequences (that will reverberate for generations to come) means the "war on terror" will never end, but Dirty Wars suffers a bit from too much voice-over. Even the film’s gorgeous cinematography — director Rick Rowley won a prize for it at Sundance earlier this year — can’t alleviate the sensation that Dirty Wars is mostly an illustrated-lecture version of Scahill’s source-material book. Still, it’s a compelling lecture. (1:26) Embarcadero, Shattuck. (Eddy)

The Guillotines Why yes, that is Jimmy Wang Yu, director and star of 1976 cult classic Master of the Flying Guillotine, in a small but pivotal role commanding a team of assassins who specialize in dispatching heads with airborne versions of you-know-which weapon. Unfortunately, this latest from Andrew Lau (best-known stateside for 2002’s Infernal Affairs, remade into Martin Scorsese’s 2006 Oscar-winner The Departed) doesn’t have nearly as much fun as it should; dudes be chopping heads off in a flurry of CG’d-up steampunky whirlygigs, but The Guillotines‘ tone is possibly even more deadly, as in deadly serious. When a rebellious prophet-folk hero known as Wolf (Xiaoming Huang) runs afoul of the Emperor’s top-secret Guillotine brotherhood, led in the field by Leng (Ethan Juan), the squad travels in disguise to a rural, smallpox-afflicted village to track him down. Along for the journey is the Emperor’s top operative, ruthless Agent Du (Shawn Yue), a boyhood friend of Leng’s. Leng and Du share a dark secret: the Guillotines have been deemed expendable — yep, in the Stallone sense — and the Emperor has decided to kill them off and replace them with armies toting guns and cannons in the name of progress. Lau is no stranger to tales of men grappling with betrayals, misplaced loyalties, and hidden personal agendas — and as historical martial-arts fantasies go, The Guillotines has higher production values than most, with sweeping, luscious photography. Too bad all the action scenes are punctuated by episodes of moody brooding — replete with slo-mo gazing off into the distance, dramatically falling tears, solemn heart-to-hearts, swelling strings, and the occasional howl of anguish. Man of Steel As beloved as he is, Superman is a tough superhero to crack — or otherwise bend into anything resembling a modern character. Director Zack Snyder and writer David S. Goyer, working with producer Christopher Nolan on the initial story, do their best to nuance this reboot, which focuses primarily on Supe’s alien origins and takes its zoom-happy space battles from Battlestar Galactica. The story begins with Kal-El’s birth on a Krypton that’s rapidly going into the shitter: the exploited planet is about to explode and wayward General Zod (Michael Shannon) is staging a coup, killing Kal-El’s father, Jor-El (Russell Crowe), the Kryptonians’ lead scientist, and being conveniently put on ice in order to battle yet another day. That day comes as Kal-El, now a 20-something earthling named Clark Kent (Henry Cavill) — resigned to his status as an outsider, a role dreamed up by his protective adoptive dad (Kevin Costner) — has turned into a bit of a (dharma) bum, looking like a buff Jack Kerouac, working Deadliest Catch-style rigs, and rescuing people along the way to finding himself. Spunky Lois Lane (Amy Adams) is the key to his, erm, coming-out party, necessitated by a certain special someone looking to reboot the Kryptonian race on earth. The greatest danger here lies in the fact that all the leached-of-color quasi-sepia tone action can turn into a bit of a Kryptonian-US Army demolition derby, making for a mess of rubble and tricky-to-parse fight sequences that, of course, will satisfy the fanboys and -girls, but will likely glaze the eyes of many others. Nevertheless, the effort Snyder and crew pack into this lengthy artifact — with its chronology-scrambling flashbacks and multiple platforms for Shannon, Diane Lane, Christopher Meloni, Laurence Fishburne, and the like — pays off on the level of sheer scale, adding up to what feels like the best Superman on film or TV to date — though that bar seems pretty easy to leap over in a single bound. Pandora’s Promise Filmmaker Robert Stone has traveled far from his first film, 1988’s Oscar-nominated anti-nuke Radio Bikini, to today, with the release of Pandora’s Promise, a detailed and guaranteed-to-be-controversial examination of nuclear power and the environmentalists who have transitioned from fervently anti- to pro-nuclear. Interviewing activists and authors like Stewart Brand, Gwyneth Cravens, Mark Lynas, and Michael Shellenberger, among others, Stone eloquently visualizes all angles of their discussion with media, industrial, and newly shot footage, starting with a visit to the largest nuclear disaster of recent years, Fukushima, which he visits with the hazmat-suited environmental activist and journalist Lynas and continuing to Chernobyl and its current denizens. Couching the debate in cultural and political context going back to World War II, Stone builds a case for nuclear energy as a viable method to provide clean, safe power for planet in the throes of climate change that will nonetheless need double or triple the current amount of energy by 2050, as billions in the developing world emerge from poverty. In a practical sense, as The Death of Environmentalism author Shellenberger asserts, "The idea that we’re going to replace oil and coal with solar and wind and nothing else is a hallucinatory delusion." Stone and his subjects put together an enticing argument to turn to nuclear as a way forward from coal, made compelling by the idea that designs for safer alternative reactors that produce less waste are out there. (1:27) Embarcadero, Shattuck. After Earth In around a century, we’ll board penitentiary-style ships and evacuate Earth for a sexier planet. Let’s call it a middle-aged migration — we all saw this coming. It’ll be dour, and we’ll feel temporary guilt for all the trees we leveled, bombs we dropped, and oil refineries we taped for 1960s industrial films. Like any body post-divorce, our planet will develop defenses against its ex — us humans — so when Will Smith and son Jaden crash land on the crater it’s toxic to them, full of glorious beasts and free as the Amazon (because it was partly filmed there). Critically wounded General Raige (Will) has to direct physically incredible Kitai (Jaden) through the future’s most dangerous Ironman triathalon. It’s more than a Hollywood king guiding his prince through a life-or-death career obstacle course, it’s a too-aggressive metaphor for adolescence — something real-world Jaden may forfeit to work with dad. Call that the tragedy beneath After Earth: it makes you wonder why the family didn’t make a movie more like 1994’s The Lion King — they had to know that was an option. Director M. Night Shyamalan again courts the Last Airbender (2010) crowd with crazy CG fights and affecting father-son dynamics, but for once, Shyamalan is basically a hired gun here. The story comes straight from Papa Smith, and one gets the feeling the movie exists primarily to elevate Jaden’s rising star. (1:40) 1000 Van Ness, SF Center, Sundance Kabuki. (Vizcarrondo)

Before Midnight Proving (again) that not all sequels are autonomic responses to a marketplace that rewards the overfamiliar, director Richard Linklater and his cowriters Julie Delpy and Ethan Hawke reconnect with the characters Céline and Jesse, whom we first encountered nearly 20 years ago on a train and trailed around Vienna for a night in Before Sunrise, then met again nine years later in Before Sunset. It’s been nine more years since we left them alone in a Paris apartment, Céline adorably dancing to Nina Simone and telling Jesse he’s going to miss his plane. And it looks like he did. The third film finds the two together, yes, and vacationing in Greece’s southern Peloponnese, where the expansive, meandering pace of their interactions — the only mode we’ve ever seen them in — is presented as an unaccustomed luxury amid a span of busy years filled with complications professional and personal. Over the course of a day and an evening, alone together and among friends, the two reveal both the quotidian intimacies of a shared life and the cracks and elisions in their love story. The East In Zal Batmanglij and Brit Marling’s powerful second film collaboration (Batmanglij directs, and the pair co-wrote the screenplay, as in 2011’s Sound of My Voice), Marling plays Sarah, an intelligence agent working for a private firm whose client list consists mainly of havoc-wreaking multinationals. Sarah, presented as quietly ambitious and conservative, is tasked by the firm’s director (Patricia Clarkson) with infiltrating the East, an off-the-grid activist collective whose members, including Benji (Alexander Skarsgård), Izzy (Ellen Page), and Doc (Toby Kebbell), bring an eye-for-an-eye sensibility to their YouTube-publicized "jams." Targeting an oil company responsible for a BP-style catastrophe, they engineer their own spill in the gated-community habitat of the company’s CEO, posting a video that juxtaposes grisly images of oil-coated shorebirds and the unsettling sight of gallons of crude seeping through the air-conditioning vents of a tidy McMansion. A newspaper headline offers a facile framework for understanding their activities, posing the alternatives as "Pranksters or Eco-Terrorists?" But as Sarah examines the gut-wrenching consequences of so-called white-collar crime and immerses herself in the day-to-day practices of the group, drawn in particular to the charismatic Benji, the film raises more complex questions. Much of its rhetorical force flows from Izzy, whom Page invests with a raw, anguished outrage, drawing our sympathies toward the group and its mission of laying bare what should be unbearable. Elemental Even those suffering from environmental-doc fatigue (a very real condition, particularly in the eco-obsessed Bay Area) will find much to praise about Elemental, co-directed by Gayatri Roshan and NorCal native Emmanuel Vaughan-Lee (who also co-composed the film’s score). This elegantly shot and edited film approaches the issues via three "eco-warriors," who despite working on different causes on various corners of the planet encounter similar roadblocks, and display like-minded determination, along the way: Rajendra Singh, on a mission to heal India’s heavily polluted Ganges River; Jay Harman, whose ingenious inventions are based on "nature’s blueprints"; and Eriel Deranger, who fights for her indigenous Canadian community in the face of Big Oil. Deranger cuts a particularly inspiring figure: a young, tattooed mother who juggles protests, her moody tween (while prepping for a new baby), and the more bureaucratic aspects of being a professional activist — from defending her grassroots methods when questioned by her skeptical employer, to deflecting a drunk, patronizing Robert F. Kennedy Jr. at a big-ticket fundraiser — with a calm, steely sense of purpose. (1:33) Smith Rafael. (Eddy)

Epic (1:42) Metreon, 1000 Van Ness, Presidio.

Fast and Furious 6 Forget the fast (that’s understood by now, anyway) — part six in this popcorny series is heavy on the "furious," with constant near-death stunts that zoom past irrational and slam into batshit crazy. Agent Hobbs (Dwayne Johnson) lures the gang out of sunny retirement to bust a fast driver with a knack for strategy and an eye on world domination. Sure, Ludacris jokes their London locale doesn’t mean they’re in a Bond movie, but give cold-blooded Luke Evans some time and he’ll work his way up to antagonizing 007. Shaw (Evans) is smaller than our hero Toretto (Vin Diesel), but he’s convincing, throwing his King’s English at a man whose murky dialect is always delivered with a devilish baritone. If Shaw’s code is all business, Toretto’s is all family: that’s what holds together this cast, cobbled from five Fast and Furious installments shot all over the world. Hottie Gal Gadot (playing Sung Kang’s love interest) reassures Han (Kang) mid-crisis: "This is what we are." It’s not for nothing the gang’s main weapon is a harpoon gun that, once shot, leaves an umbilicus from the shooter to whatever’s in the crosshairs. That’s Torreto for you. Meanwhile, the villain’s weapon is a car with a spatula-like front end, that flips cars like pancakes. The climactic battle on a cargo plane has to give a face time to every member of the eight-person team, so naturally they shot it on the world’s longest runway. Of course the parade features less car porn than previous editions but it’s got a wider reach now — it’s officially international intrigue, not just fun for gearheads. For my money, it’s some of the best action in theaters today. Stick around for the inevitable sequel-suggesting coda during the credits. (2:10) Metreon, 1000 Van Ness. (Vizcarrondo)

Fill the Void Respectfully rendered and beautifully shot in warm hues, Fill the Void admirably fills the absence on many screens of stories from what might be considered a closed world: the Orthodox Hasidic community in Israel, where a complex web of family ties, duty, and obligation entangles pretty, accordion-playing Shira (Hada Yaron). An obedient daughter, she’s about to agree to an arranged marriage to a young suitor when her much-loved sister (Renana Raz) dies in childbirth. When Shira’s mother (Irit Sheleg) learns the widower Yochay (Yiftach Klein) might marry a woman abroad and take her only grandchild far away, she starts to make noises about fixing Shira up with her son-in-law. The journey the two must take, in possibly going from in-laws to newlyweds, is one that’s simultaneously infuriating, understandable, and touching, made all the more intimate given director Rama Burshtein’s preference for searching close-ups. Her affinity for the Orthodox world is obvious with each loving shot, ultimately infusing her debut feature with a beating heart of humanity. (1:30) Albany, Clay, Smith Rafael. (Chun)

Frances Ha Noah Baumbach isn’t exactly known for romance and bright-eyed optimism. Co-writing 2009’s Fantastic Mr. Fox with director Wes Anderson is maybe the closest to "whimsy" as he’s ever come; his own features (2010’s Greenberg, 2007’s Margot at the Wedding, 2005’s The Squid and the Whale, 1997’s Mr. Jealousy, and 1995’s Kicking and Screaming) tend to veer into grumpier, more intellectual realms. You might say his films are an acquired taste. But haters beware. Frances Ha — the black-and-white tale of a New York City hipster (Baumbach’s real-life squeeze, Greta Gerwig, who co-write the script with him) blundering her way into adulthood — is probably the least Baumbach-ian Baumbach movie ever. Owing stylistic debts to both vintage Woody Allen and the French New Wave, Frances Ha relies heavily on Gerwig’s adorable-disaster title character to propel its plot, which is little more than a timeline of Frances’ neverending micro-adventures: pursuing her nascent modern-dance career, bouncing from address to address, taking an impromptu trip to Paris, visiting her parents (portrayed by the Sacramento-raised Gerwig’s real-life parents), "breaking up" with her best friend. It’s so charming, poignant, and quotable ("Don’t treat me like a three-hour brunch friend!") that even those who claim to be allergic to Baumbach just might find themselves succumbing to it. The Great Gatsby Every bit as flashy and in-your-face as you’d expect the combo of "Baz Luhrmann," "Jazz Age," and "3D" to be, this misguided interpretation of F. Scott Fitzgerald’s classic tale is, at least, overstuffed with visual delights. For that reason only, all the fashion-mag fawning over leading lady Carey Mulligan’s gowns and diamonds, and the opulent production design that surrounds them, seems warranted. And in scenes where spectacle is appropriate — Gatsby’s legendary parties; Tom Buchanan’s wild New York romp with his mistress — Luhrmann delivers in spades. The trade-off is that the subtler aspects of Fitzgerald’s novel are either pushed to the side or shouted from the rooftops. Leonardo DiCaprio, last seen cutting loose in last year’s Django Unchained, makes for a stiff, fumbling Gatsby, laying on the "Old Sports" as thickly as his pancake make-up. There’s nothing here so startlingly memorable as the actor and director’s 1996 prior collaboration, Romeo + Juliet — a more successful (if still lavish and self-consciously audacious) take on an oft-adapted, much-beloved literary work. The Hangover Part III Even the friendliest little blackout bacchanal can get tiresome the third time around. The poster depicting Bradley Cooper, Ed Helms, and Zach Galifianakis — stern in suits and ties — says it all: it’s grim men’s business, the care and maintenance of this Hangover franchise, this orgy of good times gone bad. Once a bad-taste love letter to male-bonding, Hangover Part III is ready for a chance, primed to sever some of those misbegotten ties. This time around, the unlikely troika — with the always dispensable normal-dude figurehead Doug (Justin Bartha) in tow — are captured by random sketchy figure Marshall (John Goodman, whose every utterance of the offensive "Chinaman" should bring back Big Lebowski warm-and-fuzzies). He holds Doug hostage in exchange for the amoral, cockfighting, coke-wallowing, whore-hiring, leather-wearing Leslie Chow (Ken Jeong), who stole his gold, and it turns out Alan (Galifianakis) might be his only chum. Jeong, who continues to bring the hammy glee, is still the best thing here, even as the conscience-free instigator; he’s the dark counterpart to tweaked man-child Alan, who meets cute with mean-ass pawn-star soulmate Cassie (Melissa McCarthy). Meanwhile, Cooper and Helms look on, puzzled, no doubt pondering the prestige projects on their plates and wondering what they’re still doing here. (1:40) 1000 Van Ness, SF Center, Shattuck. (Chun)

The Internship The dirty little secret of the new economy continues to be the gerbil cycle of free/cheap labor labeled "internships" that propels so many companies — be they corporate or indie, digital or print media. But gee, who’s going to see an intern comedy titled The Exploitation, besides me and my local union rep? Instead, spinning off a Vince Vaughn story idea and a co-writing credit, The Internship looks at that now-mandatory time-suck for so many college students through the filter of two older, not-quite-wiser salesmen Billy (Vaughn) and Nick (Owen Wilson) hoping to make that working guy’s quantum leap from watch sales to Google’s Mountain View campus, which director Shawn Levy casts as a bright and shiny workers wonderland with its free spring rolls and lattes, bikes, and napping pods. Departing from reality: the debugging/coding/game-playing/app-making competition that forces Billy and Nick to bond with their team of castoffs (Dylan O’Brien, Tiya Sircar, Tobit Raphael), led by noob manager Lyle (Josh Brener), in order to win a full-time job. Part of the key, naturally, turns out to be a Swingers-like visit to a strip club, to release those deeply repressed nerd sexualities — nothing like a little retrograde sexism to bring a group together. Still, the moment is offset by the generally genial, upbeat attitude brought to The Internship by its lead actors: Nick and Billy may be flubs at physics and clueless when it comes to geek culture, but most working stiffs who have suffered the slings and arrows of layoffs and dream of stable employment can probably get behind the all-American ideals of self-reinvention and optimism about the future peddled in The Internship, which easily slips in alongside The Great Gatsby among this year’s Great Recession narratives. Blink too fast and you might miss the microcameo by Google co-founder Sergey Brin. (1:59) Four Star, Marina, Metreon, 1000 Van Ness, Vogue. (Chun)

Iron Man 3 Neither a sinister terrorist dubbed "the Mandarin" (Ben Kingsley) nor a spray-tanned mad scientist (Guy Pearce) are as formidable an enemy to Tony Stark (Robert Downey, Jr.) as Tony Stark himself, the mega-rich playboy last seen in 2012’s Avengers donning his Iron Man suit and thwarting alien destruction. It’s been rough since his big New York minute; he’s been suffering panic attacks and burying himself in his workshop, shutting out his live-in love (Gwyneth Paltrow) in favor of tinkering on an ever-expanding array of manned and un-manned supersuits. But duty, and personal growth, beckon when the above-mentioned villains start behaving very badly. With some help (but not much) from Don Cheadle’s War Machine — now known as "Iron Patriot" thanks to a much-mocked PR campaign — Stark does his saving-the-world routine again. If the plot fails to hit many fresh beats (a few delicious twists aside), the 3D special effects are suitably dazzling, the direction (by series newcomer Shane Black) is appropriately snappy, and Downey, Jr. again makes Stark one of the most charismatic superheros to ever grace the big screen. For now, at least, the continuing Avengers spin-off extravaganza seems justified. (2:06) Metreon, 1000 Van Ness. (Eddy)

Kings of Summer Ah, the easy-to-pluck, easy-to-love low-hanging fruit of summer — and a coming of age. Who can blame director Jordan Vogt-Roberts and writer Chris Galletta, both TV vets, for thinking that a juicy, molasses-thick application of hee-hee-larious TV comedy actors to a Stand by Me-like boyish bildungsroman could only make matters that much more fun? When it comes to this wannabe-feral Frankenteen love child of Terrence Malick and Parks and Recreation, you certainly don’t want to fault them for original thinking, though you can understand why they keep lurching back to familiar, reliably entertaining turf, especially when it comes in the form of Nick Offerman of the aforementioned P&R, who gets to twist his Victorian doll features into new frustrated shapes alongside real-life spouse Megan Mullally. Joe (Nick Robinson) is tired of his single dad (Offerman) stepping on his emerging game, so he runs off with neurotic wrestling pal Patrick (Gabriel Basso) and stereotypically "weirdo foreign" kid Biaggio (Moises Arias) to a patch of woods. There, from scrap, they build a cool-looking house that resembles a Carmel boho shack and attempt to live off the land, which means mostly buying chicken from a Boston Market across a freeway. Pipes are pummeled, swimming holes are swum, a pathetically wispy mustachio is cultivated — read: real burly stuff, until the rising tide of testosterone threatens to poison the woodland well. Vogt-Roberts certainly captures the humid sensuality and ripe potential of a Midwestern summer — though some of the details, like the supposedly wild rabbit that looks like it came straight from Petco, look a bit canned — and who can gripe when, say, Portlandia‘s Kumail Nanjiani materializes to deliver monster wontons? You just accept it, though the effect of bouncing back and forth between the somewhat serious world of young men and the surprisingly playful world of adults, both equally unreal, grows jarring. Kings of Summer isn’t quite the stuff of genius that marketing would have you believe, but it might give the "weirdo foreign" art house crowd and TV comedy addicts something they can both stand by. Kon-Tiki In 1947 Norwegian explorer and anthropologist Thor Heyderdahl arranged an expedition on a homemade raft across the Pacific, recreating what he believed was a route by which South Americans traveled to Polynesia in pre-Columbian times. (Although this theory is now disputed.) The six-man crew (plus parrot) survived numerous perils to complete their 101-day, 4300-mile journey intact — winning enormous global attention, particularly through Heyderdahl’s subsequent book and documentary feature. Co-directors Joachim Roenning and Espen Sandberg’s dramatization is a big, impressive physical adventure most arresting for its handsome use of numerous far-flung locations. Where it’s less successful is in stirring much emotional involvement, with the character dynamics underwhelming despite a decent cast led by Pal Sverr Hagen as Thor (who, incredibly, was pretty much a non-swimmer). Nonetheless, this new Kon-Tiki offers all the pleasures of armchair travel, letting you vicariously experience a high-risk voyage few could ever hope (or want) to make in real life. Midnight’s Children Deepa Mehta (2005’s Water) directs and co-adapts with Salman Rushdie the author’s Booker Prize-winning 1981 novel, which mixes history (India’s 1947 independence, and the subsequent division of India and Pakistan) with magical elements — suggested from its fairy-tale-esque first lines: "I was born in the city of Bombay, once upon a time." This droll voice-over (read by Rushdie) comes courtesy of Saleem Sinai, born to a poor street musician and his wife (who dies in childbirth; dad is actually an advantage-taking Brit played by Charles "Tywin Lannister" Dance) but switched (for vaguely revolutionary reasons) with Shiva, born at the same moment to rich parents who unknowingly raise the wrong son. Rich or poor, it seems all children born at the instant of India’s independence have shared psychic powers; over the years, they gather for "meetings" whenever Saleem summons them. And that’s just the 45 minutes or so of story. Though gorgeously shot, Midnight’s Children suffers from page-to-screen-itis; the source material is complex in both plot and theme, and it’s doubtful any film — even one as long as this — could translate its nuances and more fanciful elements ("I can smell feelings!," Saleem insists) into a consistently compelling narrative. Last-act sentimentality doesn’t help, though it’s consistent with the fairy-tale vibe, I suppose. (2:20) Smith Rafael. (Eddy)

Much Ado About Nothing Joss Whedon (last year’s The Avengers) shifts focus for a minute to stage an adaptation of the Shakespeare comedy, drawing his players from 15 years’ worth of awesome fantasy/horror/sci-fi TV and film projects. When the Spanish prince Don Pedro (Reed Diamond) pays a post-battle visit to the home of Leonato (Clark Gregg) with his officers Claudio (Fran Kranz) and Benedick (Alexis Denisof), Claudio falls for Leonato’s daughter, Hero (Jillian Morgese), while Benedick falls to verbal blows with Hero’s cousin Beatrice (Amy Acker). Preserving the original language of the play while setting his production in the age of the iPhone and the random hookup, Whedon makes clever, inventive use of the juxtaposition, teasing out fresh sources of visual comedy as well as bringing forward the play’s oddities and darker elements. These shadows fall on Beatrice and Benedick, whose sparring — before they succumb to a playfully devious setup at the hands of their friends — has an ugly, resentful heat to it, as well as on Hero and Claudio, whose filmy romance is unsettlingly easy for their enemies, the malevolent Don John (Sean Maher) and his cohorts, to sabotage. Some of Acker and Denisof’s broader clowning doesn’t offer enough comic payoff for the hammy energy expenditure, but Nathan Fillion, heading up local law enforcement as the constable Dogberry, delivers a gleeful depiction of blundering idiocy, and the film as a whole has a warm, approachable humor while lightly exposing "all’s well that ends well"’s wacky, dysfunctional side. Now You See Me Cheese can be a tough factor to quantify, but you get close to the levels Now You See Me strives for when you picture the hopelessly goofy, tragically coiffed Doug Henning lisping, "It’s magic!" somewhere between Bob "Happy Little Tree" Ross and a rainbow sprinkled with Care Bears. Now You See Me, however, is much less likely to be dusted off and adored by a Bronies-style cult. Four seemingly savvy street and stage magicians (Jesse Eisenberg, Woody Harrelson, Isla Fisher, and Dave Franco) are brought together by tarot card invite by a mysterious host. What follows is a series of corny performances by the crew, now dubbed the Four Horseman, that are linked to a series of Robin Hood-like, or not, thefts. Nipping at their heels are a loudly flustered FBI agent (Mark Ruffalo, working an overcooked Columbo impression), a waifish Interpol detective (Mélanie Laurent, as if slouching through a Sorbonne semester), and a professional debunker (Morgan Freeman, maintaining amusement). In the course of the investigation, the Horsemen’s way-too-elaborate and far-from-apocalyptic illusions are taken apart and at least one vigorously theatrical fight scene takes place — all of which sounds more riveting than what actually transpires under the action-by-the-book watch of director Louis Leterrier, who never succeeds in making the smug, besuited puppets, I mean Horsemen, who strut around like they’re in Ocean’s Eighteen 4D, anything remotely resembling cool. Or even characters we might give a magical rabbit’s ass about. For all its seemingly knowing pokes at the truth behind the curtain, Now You See Me lacks much of the smarts and wit of loving deconstructionists like Penn and Teller —glimmers of which can only be made out in the smirk of Harrelson and the knowing twinkle of Freeman — or even the tacky machismo of Criss Angel, as well as a will to get to a truth behind the mystery. Oblivion Spoiler alert: the great alien invasion of 2017 does absolutely zilch to eliminate, or at least ameliorate, the problem of sci-fi movie plot holes. However, puny humans willing to shut down the logic-demanding portions of their brains just might enjoy Oblivion, which is set 60 years after that fateful date and imagines that Earth has been rendered uninhabitable by said invasion. Tom Cruise plays Jack, a repairman who zips down from his sterile housing pod (shared with comely companion Andrea Riseborough) to keep a fleet of drones — dispatched to guard the planet’s remaining resources from alien squatters — in working order. But Something is Not Quite Right; Jack’s been having nostalgia-drenched memories of a bustling, pre-war New York City, and the déjà vu gets worse when a beautiful astronaut (Olga Kurylenko) literally crash-lands into his life. After an inaugural gig helming 2010’s stinky Tron: Legacy, director Joseph Kosinski shows promise, if not perfection, bringing his original tale to the screen. (He does, however, borrow heavily from 1968’s 2001: A Space Odyssey, 1996’s Independence Day, and 2008’s Wall-E, among others.) Still, Oblivion boasts sleek production design, a certain creative flair, and some surprisingly effective plot twists — though also, alas, an overlong running time. (2:05) Metreon. (Eddy)

1 Mile Above When his brother dies suddenly, sheltered Taiwanese student Shuhao takes possession of the older boy’s "riding diaries," determined to complete his sibling’s dream of biking to the highest point in Tibet. It’d be a perilous journey even for an experienced cyclist — but Shuhao’s got gutsy determination that (almost) makes up for his wobbly wheels. Fortunately, nearly everyone he meets en route to Lhasa is a kind-hearted soul, including a food-obsessed fellow traveler who doles out advice on how to avoid government checkpoints, prevent "crotch trouble" (from all that riding), and woo women, among other topics. (The cruel weather, steep inclines, and hostile wild dogs he faces, however, aren’t as welcoming.) Jiayi Du’s based-on-true-events drama doesn’t innovate much on similar adventure tales — spoiler alert: it’s the journey, not the destination, that counts — but it admirably avoids melodrama for the most part, and the gorgeous location photography is something to behold. The Purge Writer-director James DeMonaco founds his dystopian-near-future tale on the possibly suspect premise that the United States could achieve one percent unemployment, heavily reduced crime rates, and a virtually carb-free society if only it were to sanction an annual night of national mayhem unconstrained by statutory law — up to and including those discouraging the act of homicide. Set in 2022, The Purge visits the household of home security salesman James Sandin (Ethan Hawke), wife Mary (Lena Headey), and their children, Charlie (Max Burkholder) and Zoey (Adelaide Kane), as the annual festivities are about to begin, and the film keeps us trapped in the house with them for the next 12 hours of bloodletting sans emergency services. While they show zero interest in adding to the carnage, James and Mary seem to be largely on board with what a news commentator describes as "a lawful outlet for American rage," not giving too much credence to detractors’ observations that the purge is a de facto culling of the underclass. Clearly, though, the whole family is about to learn a valuable lesson. It comes when Charlie, in an act of baseline humanity, draws the ire of a gang of purgers running around in bathrobes, prep school jackets, and creepy masks, led by a gleaming-eyed alpha-sociopath whom DeMonaco (whose other screenplay credits include 2005’s Assault on Precinct 13 remake) tasks with wielding the film’s blunt-object message alongside his semi-automatic weaponry. Rebels with a Cause The huge string of parklands that have made Marin County a jewel of preserved California coastline might easily have become wall-to-wall development — just like the Peninsula — if not for the stubborn conservationists whose efforts are profiled in Nancy Kelly’s documentary. From Congressman Clem Miller — who died in a plane crash just after his Point Reyes National Seashore bill became a reality — to housewife Amy Meyer, who began championing the Golden Gate National Recreation Area because she "needed a project" to keep busy once her kids entered school, they’re testaments to the ability of citizen activism to arrest the seemingly unstoppable forces of money, power and political influence. Theirs is a hidden history of the Bay Area, and of what didn’t come to pass — numerous marinas, subdivisions, and other developments that would have made San Francisco and its surrounds into another Los Angeles. Renoir The gorgeous, sun-dappled French Riviera setting is the high point of this otherwise low-key drama about the temperamental women (Christa Theret) who was the final muse to elderly painter Auguste Renoir (Michel Bouquet), and who encouraged the filmmaking urges in his son, future cinema great Jean (Vincent Rottiers). Cinematographer Mark Ping Bin Lee (who’s worked with Hou Hsiao-hsein and Wong Kar Wai) lenses Renoir’s leafy, ramshackle estate to maximize its resemblance to the paintings it helped inspire; though her character, Dédée, could kindly be described as "conniving," Theret could not have been better physically cast, with tumbling red curls and pale skin she’s none too shy about showing off. Though the specter of World War I looms in the background, the biggest conflicts in Gilles Bourdos’ film are contained within the household, as Jean frets about his future, Dédée faces the reality of her precarious position in the household (which is staffed by aging models-turned-maids), and Auguste battles ill health by continuing to paint, though he’s in a wheelchair and must have his brushes taped to his hands. Though not much really happens, Renoir is a pleasant, easy-on-the-eyes experience. (1:51) Smith Rafael. (Eddy)

Shadow Dancer Watching the emotions flicker across the exquisitely smooth, pale plane of Andrea Riseborough’s face is one of the central pleasures of Shadow Dancer. Likely the surest step Madonna made in making 2011’s W.E. was choosing the actress as her Wallis Simpson — her features fall together with the sweet symmetry of a, well, Madonna, and even when words, or the script, fail her, the play of thoughts and feelings rippling across her brow can fill out a movie’s, or a character’s, failings admirably. The otherwise graceful, good-looking Shadow Dancer fumbles over a few in the course of resurrecting the Troubles tearing apart Belfast in the 1990s. After feeling responsible for the death of a younger brother who got caught in the crossfire, Collette (Riseborough) finds herself a single mom in league with the IRA. Caught after a scuttled bombing, the petite would-be terrorist is turned by Mac (Clive Owen) to become an informant for the MI5, though after getting quickly dragged into an attempted assassination, Collette appears to be way over her head and must be pulled out — something Mac’s boss (Gillian Anderson) won’t allow. Director James Marsh (2008’s Man on Wire) brings a keen attention to the machinations and tested loyalties among both the MI5 and IRA, an interest evident in his Red Riding: In the Year of Our Lord 1980 (2009), and even imbues otherwise blanked-out, non-picturesque sites like hotel suites and gray coastal walks with a stark beauty. Unfortunately the funereal pacing and gaps in plotting, however eased by the focus on Riseborough’s responses, send the mind into the shadows. (1:44) Opera Plaza. (Chun)

Star Trek Into Darkness Do you remember 1982? There are more than a few echoes of Star Trek II: The Wrath of Khan in J. J. Abrams’ second film retooling the classic sci-fi property’s characters and adventures. Darkness retains the 2009 cast, including standouts Zachary Quinto as Spock and Simon Pegg as comic-relief Scotty, and brings in Benedict "Sherlock" Cumberbatch to play the villain (I think you can guess which one). The plot mostly pinballs between revenge and preventing/circumventing the destruction of the USS Enterprise, with added post-9/11, post-Dark Knight (2008) terrorism connotations that are de rigueur for all superhero or fantasy-type blockbusters these days. But Darkness isn’t totally, uh, dark: there’s quite a bit of fan service at work here (speak Klingon? You’re in luck). Abrams knows what audiences want, and he’s more than happy to give it to ’em, sometimes opening up massive plot holes in the process — but never veering from his own Prime Directive: providing an enjoyable ride. Stories We Tell Actor and director Sarah Polley (2011’s Take This Waltz) turns the camera on herself and her family for this poignant, moving, inventive, and expectation-upending blend of documentary and narrative. Her father, actor Michael Polley, provides the narration; our first hint that this film will take an unconventional form comes when we see Sarah directing Michael’s performance in a recording-studio booth, asking him to repeat certain phrases for emphasis. On one level, Stories We Tell is about Sarah’s own history, as she sets out to explore longstanding family rumors that Michael is not her biological father. The missing piece: her mother, actress Diane Polley (who died of cancer just days after Sarah’s 11th birthday), a vivacious character remembered by Sarah’s siblings and those who knew and loved her. Stories We Tell‘s deeper meaning emerges as the film becomes ever more meta, retooling the audience’s understanding of what they’re seeing via convincingly doc-like reenactments. To say more would lessen the power of Stories We Tell‘s multi-layered revelations. Just know that this is an impressively unique film — about family, memories, love, and (obviously) storytelling — and offers further proof of Polley’s tremendous talent. (1:48) Smith Rafael. (Eddy)

Violet and Daisy The 1990s revival has already infiltrated fashion and music; Violet and Daisy, the directorial debut of Oscar-winning Precious (2009) screenwriter Geoffrey Fletcher, suggests that cinema may be next. Unfortunately, not enough time has passed since the first wave of Pulp Fiction (1994) knockoffs to make the genre feel particularly interesting again. And yet here comes a pair of assassins dressed as nuns, cracking long-winded jokes before unloading on their targets with guns they’ve concealed in pizza boxes … as an AM radio hit ("Angel of the Morning") swells in the background, and Danny Trejo stops by for a cameo. At least this Tarantino-lite exploration of crime and daddy issues has an appealing cast; besides Trejo, Alexis Bledel (sporting Mia Wallace bangs) and Saoirse Ronan play the jailbait titular killers, and James Gandolfini pops in as a sad-sack who manages to evade their bullets because, like, he’s nice and stuff. Despite their efforts, the over-stylized Violet and Daisy comes off like a plate of leftovers reheated too long after the fact. (1:28) Metreon. (Eddy)

What Maisie Knew In Scott McGehee and David Siegel’s adaptation of the 1897 Henry James novel, the story of a little girl caught between warring, self-involved parents is transported forward to modern-day New York City, with Julianne Moore and Steve Coogan as the ill-suited pair responsible, in theory, for the care and upbringing of the title character, played by Onata Aprile. Moore’s Susanna is a rock singer making a slow, halting descent from some apex of stardom, as we gather from the snide comments of her partner in dysfunctionality, Beale (Coogan). As their relationship implodes and they move on to custody battle tactics, each takes on a new, inappropriate companion — Beale marrying in haste Maisie’s pretty young nanny, Margo (Joanna Vanderham), and Susanna just as precipitously latching on to a handsome bartender named Lincoln (True Blood‘s Alexander Skarsgård). The film mostly tracks the chaotic action — Susanna’s strung-out tantrums, both parents’ impulsive entrances and exits, Margo and Lincoln’s ambivalent acceptance of responsibility — from Maisie’s silent vantage, as details large and small convey, at least to us, the deficits of her caretakers, who shield her from none of the emotional shrapnel flying through the air and rarely bother to present an appropriate, comprehensible explanation. Yet Maisie understands plenty — though longtime writing-and-directing team McGehee and Siegel (2001’s The Deep End, 2005’s Bee Season, 2008’s Uncertainty) have taken pains in their script and their casting to present Maisie as a lovely, watchful child, not the precocious creep often favored in the picture shows. So we watch too, with a grinding anxiety, as she’s passed from hand to hand, forced to draw her own unvoiced conclusions. (1:38) Opera Plaza. (Rapoport)

The bias in the liberal media is crippling the valiant patriot but to re-implement the Fairness Doctrine (where both sides would get equal time) stifles the same valiant patriot.

An undocumented immigrant must wait ten years and pay massive fines to become an American citizen or at least work here legally and that’s nowhere near the imposition of a half hour background check.

Scientists on no industry’s payroll that say man made climate change is real only do so for “reasons of political advantage” (that are never explained) while scientists that do not are always on the petroleum industry’s payroll are work in “think tanks” funded by same.

In order for Jesus to return, Jews must occupy certain sections of Jerusalem and once they do, Christ (a Jew) will slaughter all but 144 of them. AKA “The Rapture”, a biblical event that’s not in the Bible.

Poor people caused the real estate crash of 2008. Without owning anything.

ACORN’s fraudulent voter registration cost the GOP the White House in 2008 as well. ACORN registered 2 million voters over the course of its entire existence and Obama won by 9.7 million votes.

Sharing bicycles in New York, says one of their mouthpieces in the Wall Street Journal, is “totalitarianism” (because the bikes all look alike)(Bicycles really do set these people off, bike lanes in Colorado, according to the same Right is part of the UN-installed New World Order).

Solar power is more effective in Germany, because they get more sunlight. Never mind that Boston is hundreds of miles south of middle Germany as is Seattle, those two bastions of great sunny weather.

These came to me in 10 minutes. 

These are core beliefs of one of this country’s two major political parties.

Mt Everest and tantrum-tossing talk junkies

The world has been rather ugly of late, hasn’t it? From man-made horrors in Turkey as the government sprays its people with agent orange to Syria’s unending conflict to Mother Nature’s wrath in Oklahoma–more trouble every day as the Mothers sang in 1966. So when I saw an article on Mt. Everest, the highest place on the planet (outside of Burning Man, of course), I figured it might be a heartwarming look at mountaineering. Oh how wrong I was.

Anecdotally and via computer model, Mt Everest and much of the Himalayas have become ground zero for a warming earth. With a snow line rising almost 600 feet and glacier fed rivers drying up, the world’s summit is like a rocky measuring stick for the damage fossil fuels are doing. In fact, the Sherpas–the locals that haul climbers up and down the mountain for a living–are saying that the climb is becoming much more dangerous, as what was once frozen is now thawed and loose and falling. 

Not like this is really any surprise to legitimate science, which by 97% believes climate change is happening and man made. Nor is it any surprise to deniers of same that will contort themselves into pretzel shapes trying to defend their paymasters, the oil, natural gas and coal companies. But at this point, given that predictions of more severe climate have come to pass, how can anyone anywhere say this isn’t so (Joe)?

The reason is the same as it’s always been, at least in the US. An enormous segment of the population feels put upon and offended at the idea that their God-derived right to squander resources is being impacted. The fact that said segment considers itself “conservative” is one of the cruelest and most insane semantic games extent–cherishing the privilege to waste as an almost constitutionally-mandated right is the polar opposite of conservation.

These are, after all, the same foolish people that blew a headgasket over energy-saving lightbulbs. That so many of them live proximitous to beaches and continue to act so capriously when their own property may resemble a structure in an aquarium in 30 years matters not–why is this?

Because at heart, the American reactionary is a tantrum-throwing five year old. Exercising their power by screaming and throwing themselves on the ground when they don’t get their way 100% of the time is how a kid makes their unhappiness felt by an adult. That these are adults, at least by age, is flummoxing. By making the rest of the world suffer from their fit throwing is ultimately gratifying to people who have no real say in anything–best of all, it “pisses off the libs”, which translated into English means “anyone smarter and saner than I am who I resent for that”. Oy.

Any San Franciscan that goes along with this ugly strain of arrested development has a slow death wish. Rising seas mean a flooded Marina and Mission frequently as opposed to rarely. They mean Treasure Island disappears sooner rather than later. But because the sheer, puerile joy of giving the raspberry to those tweedy know it alls from Berkeley is too much fun, they’ll happily see lower Market Street into a Venetian canal.

As Ray Davies sang, ‘‘they’re conditioned that way”. Too bad the rest of us have to suffer physically because these fools refuse to face reality even as it drowns, floods or draughts them to death.

Planning for displacement

The intersection of Cesar Chavez and Evans Avenue is a good enough place to start. Face south.

Behind you is Potrero Hill, once a working-class neighborhood (and still home to a public housing project) where homes now sell for way more than a million dollars and rents are out of control. In front, down the hill, is one of the last remaining industrial areas in San Francisco.

Go straight along Evans and you find printing plants, an auto-wrecking yard, and light manufacturing, including a shop that makes flagpoles. Take a right instead on Toland, past the Bonanza restaurant, and you wander through auto-glass repair, lumber yards, plumbing suppliers, warehouses, the city’s produce market — places that the city Planning Department refers to at Production, Distribution, and Repair facilities. Places that still offer blue-collar employment. There aren’t many left anywhere in San Francisco, and it’s amazing that this district has survived.

Cruise around for a while and you’ll see a neighborhood with high home-ownership rates — and high levels of foreclosures. Bayview Hunters Point is home to much of the city’s dwindling African American population, a growing number of Asians, and much higher unemployment rates than the rest of the city.

Now pull up the website of the Association of Bay Area Governments, a well-funded regional planning agency that is working on a state-mandated blueprint for future growth. There’s a map on the site that identifies “priority development area” — in planning lingo, PDAs — places that ABAG, and many believers in so-called smart growth, see as the center of a much-more dense San Francisco, filled with nearly 100,000 more homes and 190,000 new jobs.

Guess what? You’re right in the middle of it.

The southeastern part of the city — along with many of the eastern neighborhoods — is ground zero for massive, radical changes. And it’s not just Bayview Hunters Point; in fact, there’s a great swath of the city, from Chinatown/North Beach to Candlestick Park, where regional planners say there’s space for new apartments and condos, new offices, new communities.

It’s a bold vision, laid out in an airy document called the Plan Bay Area — and it’s about to clash with the facts on the ground. Namely, that there are already people living and working in the path of the new development.

And there’s a high risk that many of them will be displaced; collateral damage in the latest transformation of San Francisco.

CLIMATE CHANGE AND “SMART GROWTH”

The threat of global climate change hasn’t convinced the governor or the state Legislature to raise gas taxes, impose an oil-severance tax, or redirect money from highways to transit. But it’s driven Sacramento to mandate that regional planners find ways to reduce greenhouse gas emissions in California cities.

The bill that lays this out, SB375, mandates that ABAG, and its equivalents in the Los Angeles Basin, the Central Coast, the Central Valley and other areas, set up “Sustainable Communities Strategies” — land-use plans for now through 2040 intended to reduce greenhouse gas emissions by 15 percent.

The main path to that goal: Make sure that most of the 1.1 million people projected to live in the Bay Area by 2040 be housed in already developed areas, near transit and jobs, to avoid the suburban sprawl that leads to long commutes and vast amounts of car exhaust.

The notion of smart growth — also referred to as urban infill — has been around for years, embraced by a certain type of environmentalist, particularly those concerned with protecting open space. But now, it has the force of law.

And while ABAG is not a secret government with black helicopters that can force cities to do its will — land-use planning is still under local jurisdiction in this state — the agency is partnering with the Metropolitan Transportation Commission, which controls hundreds of millions of dollars in state and federal transportation money. And together, they can offer strong incentives for cities to get in line.

Over in Contra Costa and Marin counties, at hearings on the plan, Tea Party types (yes, they appear to exist in Marin) railed against the notion of elite bureaucrats forcing the wealthy enclaves of single-family homes to accept more density (and, gasp, possibly some affordable housing). In San Francisco, it’s the progressives, the transit activists, and the affordable housing people who are starting to get worried. Because there’s been almost zero media attention to the plan, and what it prescribes for San Francisco is alarming — and strangely nonsensical.

Under the ABAG plan, San Francisco would approve 92,400 more housing units for 280,000 more people. The city would host 190,000 more jobs, many of them in what’s called the “knowledge economy,” which mostly means high tech. Second and third on the list: Health and education, and tourism.

The city currently allows around eight cars for every 10 housing units; as few as five in a few neighborhoods, at least 10 in many others. And there’s nothing in any city or regional plan right now that seeks to change that level of car dependency. In fact, the regional planners think that single-occupancy car travel will be the mode of choice for 48 percent of all trips by 2040 — almost the same as it is today.

And since most of the new housing will be aimed at wealthier people, who are more likely to own cars and avoid catching buses, San Francisco could be looking for ways to fit 73,000 more cars onto streets that are already, in many cases, maxed out. There will be, quite literally, no place to park. And congestion in the region, the planners agree, will get a whole lot worse.

That seems to undermine the main intent of the plan: Transit-oriented development only works if you discourage cars. In a sense, the car-use projections are an admission of failure, undermining the intent of the entire project.

The vast majority of the housing that will be built will be too expensive for much of the existing (and even future) workforce and will do little to relieve the pressure on lower income people. But there is nothing whatsoever in the plan to ensure that there’s money available to build housing that meets the needs of most San Franciscans.

Instead, the planners acknowledge that 36 percent of existing low-income people will be at risk for displacement. That would be a profound change in the demographics of San Francisco.

Of course, adding all those people and jobs will put immense pressure on city services, from Muni to police, fire, and schools — not to mention the sewer system, which already floods and dumps untreated waste into the Bay when there’s heavy rain. Everyone involved acknowledged those costs, which could run into the billions of dollars. There is nothing anywhere in any of the planning documents addressing the question of who will pay for it.

THE NUMBERS GAME

Projecting the future of a region isn’t easy. Job and population growth isn’t a straight line, at best — and when you’re looking at a 25-year window in a boom-and-bust area with everything from earthquakes to sea-level rise factoring in, it’s easy to say that anyone who claims to know what’s going to happen in 2040 is guessing.

But as economist Stephen Levy, who did the regional projections for ABAG, pointed out to us, “You have to be able to plan.” And you can’t plan if you don’t at least think about what you’re planning for.

Levy runs the Center for the Continuing Study of the California Economy, and he’s been watching trends in this state for years. He agrees that some of his science is, by nature, dismal: “Nobody projects deep recessions,” much less natural disasters. But overall, he told me, it’s possible to get a grip on what planners need to prepare for as they write the next chapter of the Bay Area’s future.

And what they have to plan for is a lot more people.

Levy said he started with the federal government’s projections for population growth in the United States, which include births and deaths, immigration, and out-migration, using historic trends to allocate some of that growth to the Bay Area. There’s what appears at first to be circular logic involved: The feds (and most economists) project that job growth nationally will be driven by population — that is, the more people live in the US, the more jobs there will be.

Population growth in a specific region, on the other hand, is driven by jobs — that is, the more jobs you have in the Bay Area, the more people will move here.

“Jobs in the US depend on how many people are in the labor force,” he said. “Jobs in the Bay Area depend on our share of US jobs and population depends on relative job growth.”

Make sense? No matter — over the years it’s generally worked. And once you project the number of people and jobs expected in the Bay Area, you can start looking at how much housing it’s going to take to keep them all under a roof.

Levy projects that the Bay Area’s share of jobs will be higher than most of the rest of the country. “This is the home of the knowledge industry,” he told me. So he’s concluded that population in the Bay Area will grow from 7.1 million to 9.2 million — an additional 2.14 million people. They’ll be chasing some 1.1 million new jobs, and will need 660,000 new housing units.

Levy stopped there, and left it to the planners at ABAG to allocate that growth to individual cities — and that’s where smart growth comes in.

For decades in the Bay Area, particularly in San Francisco, activists have waged wars against developers, trying to slow down the growth of office buildings, and later, luxury housing units. At the same time, environmentalists argued that spreading the growth around creates serious problems, including sprawl and the destruction of farmland and open space.

Smart growth is supposed to be an alternative: the idea is to direct new growth to already-established urban areas, not by bulldozing over communities (as redevelopment agencies once did) but by the use of “infill” — directing development to areas where there’s usable space, or by building up and not out.

ABAG “focused housing and jobs growth around transit areas, particularly within locally identified Priority Development Areas,” the draft environmental impact report on the plan notes.

The draft EIR is more than 1,300 pages long, and it looks at the ABAG plan and several alternatives. One alternative, proposed by business groups, would lead to more development and higher population gains. Another, proposed by community activist groups including Public Advocates, Urban Habitat, and TransForm, is aimed at reducing displacement and creating affordable housing; that one, it turns out, is the “environmentally preferred alternative.” (See sidebar).

But no matter which alternative you look at, two things leap out: There is nothing effective that ABAG has put forward to prevent large-scale displacement of vulnerable communities. And despite directing growth to transit corridors, the DEIR still envisions a disaster of traffic congestion, parking problems, and car-driven environmental wreckage.

THE DISPLACEMENT PROBLEM

ABAG has gone to some lengths to identify what it calls “communities of concern.” Those are areas, like Bayview Hunters Point, Chinatown, and the Mission, where existing low-income residents and small businesses face potential displacement. In San Francisco, those communities are, to a great extent, the same geographic areas that have been identified as PDAs.

And, the DEIR, notes, some degree of displacement is a significant impact that cannot be mitigated. In other words, the gentrification of San Francisco is just part of the plan.

In fact, the study notes, 36 percent of the communities of concern in high-growth areas will face displacement pressure because of the cost of housing. And that’s region wide; the number in San Francisco will almost certainly be much, much higher.

Miriam Chion, ABAG’s planning and research director, told me that displacement “is the core issue in this whole process.” The agency, she said, is working with other stakeholders to try to address the concern that new development will drive out longtime residents. But she also agreed that there are limited tools available to local government.

The DEIR notes that ABAG and the MTC will seek to “bolster the plan’s investment in the Transit Oriented Affordable Housing Fund and will seek to do a study of displacement. It also states: “In addition, this displacement risk could be mitigated in cities such as San Francisco with rent control and other tenant protections in place.”

There isn’t a tenant activist in this town who can read that sentence with a straight face.

The problem, as affordable housing advocate Peter Cohen puts it, is that “the state has mandated all this growth, but has taken away the tools we could use to mitigate it.”

That’s exactly what’s happened in the past few decades. The state Legislature has outlawed the only effective anti-displacement laws local governments can enact — rent controls on vacant apartments, commercial rent control, and eviction protections that prevent landlords from taking rental units off the market to sell as condos. Oh, and the governor has also shut down redevelopment agencies, which were the only reliable source of affordable housing money in many cities.

Chion told me that the ABAG planners were discussing a list of anti-displacement options, and that changes in state legislation could be on that list. Given the power of the real-estate lobby in the state Capitol, ABAG will have to do more than suggest; there’s no way this plan can work without changing state law.

Otherwise, eastern San Francisco is going to be devastated — particularly since the vast majority of all housing that gets built in the city, and that’s likely to get built in the city, is too expensive for almost anyone in the communities of concern.

“This plan doesn’t require affordable housing,” Cindy Wu, vice-chair of the San Francisco Planning Commission, told me. “It’s left to the private market, which doesn’t build affordable housing or middle-class housing.”

In fact, while there’s plenty of discussion in the plan about where money can come from for transit projects, there’s virtually no discussion of the billions and billions that will be needed to produce the level of affordable housing that everyone agrees will be needed.

Does anyone seriously think that developers can cram 90,000 new units — at least 85 percent of them, under current rules, high-cost apartments and condos that are well beyond the range of most current San Franciscans — into eastern neighborhoods without a real-estate boom that will displace thousands of existing residents?

Let’s remember: Building more housing, even a lot more housing, won’t necessarily bring down prices. The report makes clear that the job growth, and population boom that accompanies it, will fuel plenty of demand for all those new units.

Steve Woo, senior planner with the Chinatown Community Development Center, sees the problem. In a letter to ABAG, he notes: “Plan Bay Area and its DEIR has analyzed the displacement of low-income people and explicitly acknowledges that it will occur. This is unacceptable for San Francisco and for Chinatown, where the pressures of displacement have been a constant over the past 20 years.”

Adds the Council of Community Housing Organizations: “It would be irresponsible for the regional agencies to advance a plan that purports to ‘improve’ the region’s communities as population grows while the plan simultaneously presents great risk and uncertainty for many vulnerable communities.”

Jobs are at stake, too — not tech jobs or office jobs, which ABAG projects will expand, but the kind of industrial jobs that currently exist in the priority development areas.

Calvin Welch, who has been watching urban planning and displacement issues in San Francisco for more than 40 years, puts it bluntly: “It is axiomatic that market-rate housing drives out blue-collar jobs,” he said.

Of course, there’s another potential problem: Nobody really knows where jobs will come from in the next 25 years, whether tech will continue to be the driver or whether the city’s headed for a second dot-com bust. San Francisco doesn’t have a good record of building for projected jobs: In the mid-1980s, for example, the entire South of Market area (then home to printing, light manufacturing, and other blue-collar jobs) was rezoned for open-floor office space because city officials projected a huge need for “back-office” functions like customer service.

“Where are all those jobs today?” Welch asked. “They’re in India.”

TOO MANY CARS

For a plan that’s designed to reduce greenhouse gas emissions by moving residential development closer to work areas, Plan Bay Area is awfully pessimistic about transportation.

According to the projections, there will be more cars on the roads in 2040, with more — and much worse — traffic. The DEIR predicts that a full 48 percent of all trips in 2040 will be made by single-occupant vehicles — just slightly down from current rates. The percentage of trips on transit will only be a little bit higher — and there’s no significant increase in projected bicycle trips.

That alone is pretty crazy, since the number of people commuting to work by bike in San Francisco has risen dramatically in the past 10 years, and the city’s official goal is that 20 percent of all vehicle trips will be by bike in the next decade.

Part of the problem is structural. Not everyone in San Francisco 2040 is going to be a high-paid tech worker. In fact, the most stable areas of employment are health services and government — and hospital workers and Muni drivers can’t possibly afford the housing that’s being built. So those people will — the DEIR acknowledges — be displaced from San Francisco and forced to live elsewhere in the region (if that’s even possible). Which means, of course, they’ll be commuting further to work. Meanwhile, if current trends continue, many of the people moving into the city will work in Silicon Valley.

Chion and Levy both told me that the transit mode projections were based on historical trends for car use, and that it’s really hard to get people to give up their cars. Even higher gas prices and abominable traffic delays won’t drive people off the roads, they said.

If that’s the case — if auto culture, which is a top source of global climate change, doesn’t shift at all — it would seem that all this planning is pointless: the seas will rise dramatically, and San Franciscans ought to be buying boats.

“The projections don’t take into account social change,” Jason Henderson, a geography professor at San Francisco State University and a local transportation expert, told me. “And social change does happen.”

Brad Paul, a longtime housing activist who now works for ABAG, said these projections are just a start, and that the plan will be updated every four years. “I think we’re finding that the number of people who want to drive cars will go down,” he said.

Henderson argues that the land-use policy is flawed. He suggests that it would make more sense to increase density in the Bay Area suburbs along the BART lines. “Elegant development in those areas would work better,” he said. You don’t need expensive high-rises: “Four and five stories is the sweet spot,” he explained.

Most of the transportation projects in the plan are already in the pipeline; there’s no suggestion of any major new public transit programs. There is, however, a suggestion that San Francisco adopt a congestion management fee for downtown driving — something that city officials say is the only way to avoid utter gridlock in the future.

SIDELINING CEQA

ABAG and the MTC have a fair amount of leverage to implement their plans. MTC controls hundreds of millions of dollars in transit money; ABAG will be handing out millions in grants to communities that adopt its plan. And under state law, cities that allow development in PDAs near transit corridors can gain an exemption from the California Environmental Quality Act.

CEQA is a powerful tool to slow or halt development, and developers (and some public officials) drool at the prospect of getting a fast-track pass to avoid some of the more cumbersome parts of the environmental review process.

Under SB 375 and Plan Bay Area, CEQA exemptions are available to projects that meet the Sustainable Community Strategy standards and are close to transit corridors. And when you look at the map of those areas, it’s pretty striking: All of San Francisco, pretty much every square inch, qualifies.

That means that almost any project almost anywhere in town can make a case that it doesn’t need to accept full CEQA review.

The most profound missing element in this entire discussion is the cost of all this growth.

You can’t cram 210,000 more residents into San Francisco without new schools, parks, and child-care centers. You can’t protect those residents without more police officers and firefighters. You can’t take care of their water and sewer needs without substantial infrastructure upgrades. And even if there’s state and federal money available for new buses and trains, you can’t operate those systems without paying drivers, mechanics, and support workers.

There’s no question that the new development will bring in more tax money. But the type of infrastructure improvements that will be needed to add 25 percent more residents to the city are really expensive — and every study that’s ever been done in San Francisco shows that the tax benefits of new development don’t cover the costs of public services it requires.

When World War II and the post-war boom in the Bay Area brought huge growth to the region, property taxes and federal and state money were adequate to build things like BART, the freeways, and hundreds of new schools, and to staff the public services that the emerging communities needed. But that all changed in 1978, with the passage of Prop. 13, and two years later, with the election of Ronald Reagan as president.

Now, federal money for cities is down to a trickle. Local government has an almost impossible time raising taxes. And instead of hiking fees for new residential and commercial projects, many communities (including San Francisco) are offering tax breaks to encourage job growth.

Put all that in the mix and you have a recipe for overcrowded buses, inadequate schools, overstressed open space (imagine 10,000 new Mission residents heading for Dolores Park on a nice day), and a very unattractive urban experience.

That flies directly in the face of what Plan Bay Area is supposed to be about. If the goal is to cut down on commutes by bringing new residents into developed urban areas, those cities have to be decent places to live. What would it cost to accommodate this level of new development? Five billion dollars? Ten billion? Nobody knows — because nobody has run those numbers. But they’re going to be big.

Because just as tax dollars have been vanishing, the costs of infrastructure keep going up. It costs a billion dollars a mile to build BART track. It’s costing more than a billion to build a short subway to Chinatown. Just upgrading the sewer system to handle current demands is a $4 billion project.

And if the developers and property owners who stand to make vast sums of money off all of this growth aren’t going to pay, who’s left?

The ABAG planners point out, correctly, that there’s a price for doing nothing. If there’s no regional plan, no proposal for smart growth, the population will still increase, and displacement will still happen — but the greenhouse gas emissions will be even worse, the development more haphazard.

But if the region is going to spend all this money and all this time on a plan to make the Bay Area more sustainable, more livable, and more affordable in 25 years, we might as well push all the limits and get it right.

Instead of looking at displacement as inevitable, and traffic as a price of growth, the planners could tell the state Legislature and the governor that it’s not possible to comply with SB375 — not until somebody identifies the big sums of money, multiples of billions of dollars, needed to build affordable housing; not until there are transit options, taxes, and restrictions on driving.

Because continued car use and massive displacement — the package that’s now facing us — just isn’t an acceptable option.

Thou Shalt Not Speak Ill Of The Lord God Oil

Every Monday, Wednesday and Friday morning, I take a brutal boot-camp type class at the Hollywood YMCA here in LA. 45 minutes of sheer hell, but as these things are measured, surely worth it. I’ve been going for the last year and a half at the prodding and urging of my friend Stacy “Beano” Johnson, a lively and lovely woman and an ex-pat Okie from outside Tulsa. Yesterday, I walked in to find her strecthing and she seemed, as you would imagine, distraught. Her state is devastated. Despite downward revisions of casualties, at least 24 people were killed by the storm and the cost to insurers will be over 1 billion dollars. Luckily, none of her family or friends were among the dead or wounded.

Because we are 1) good friends and 2) I am by nature very inquisitve, I asked her if her people back there were putting some of the cause on this particularly violent and early in the year twister on man-made climate change. Beano turned kind of reddish and responded “hell yeah they do. And why wouldn’t they? Summers are getting hot as hell there and it feels like it’s headed to 120 degrees when we go back for vacation. I know damned well it is”.

She isn’t a scientist and is also a self-proclaimed “California liberal” (by way of disclaimer). But this is nothing new to anyone with kin in “flyover country”–my younger brother has been telling me for ten years that the farmers in “Tornado Alley” where he is in Western Illinois talk about the heating and extremes and the effect on crops–and, as Beano has said, why wouldn’t they? 2010 was one of the hottest years on record, another freak tornado devastated Joplin MO in 2011, a drought nearly destroyed the entire Midwest’s crop output last year and now this. Yes–this is where tornadoes happen and they have been happening forever. But scientists warned us that “weather patterns are going to get more extreme and more violent” as the planet heats up and yes it has, and according to 97% of said scientists, the culprit is fossil fuels.

That no peer-reviewed publication has said otherwise and that the only “scientists” that claim that the jury is out tend to be on oil company payrolls isn’t exactly a new revelation. But in Oklahoma, were any politician to claim that the destruction in Moore was because of man-made climate change, they’d be demolished in the next election like so many of the homes were a few days ago.

And why? Because oil is one of the state’s biggest employers, in refining and extraction and logistics. Koch is king in the Sooner State. And even though the average Okie is beginning to see the light, they are willing to look the other way when their livelihood is concerned–their jobs are, in a way, literally to die for.

It is disgusting and sad and vile, but as Louisiana governor Bobby Jindal could tell you, there’s no percentage to ever attack the mighty hand of the petro-oligarchy. Despite the cheapskate idiocy by British Petroleum that nearly ruined that state’s fishing and tourism industries, at no point did Jindal demand that BP pay for all the damage they’d wreaked.

And so the oil companies continue their version of bullshit, as their exec’s declare that to destroy the planet is “God’s will” and their paid shills in broadcasting claim zero culpability, the planet roasts and the people of Moore are wondering where they’re gonna live. And if you think this is just far fetched lefty hand wringing, even the almighty insurance industry knows climate change is real and are changing their rates accordingly. These people play the “life and death odds” for a living in actuarial tables. They know.

Meanwhile, Oklahoma’s two Republican senators are asking for the same federal aid that they denied to Jersey and New York, “God’s will” is again invoked (by America’s #1 publicity hound family) and no one dares speak the truth, that black gold and natural gas are slowly cooking its users and that these same people will battle renewable and clean power with every trick in their arsenal even as it makes their grand-kids lives sheer misery. You might say that the denial is as high as an elephant’s eye in O-kla-Homa……

Brown raids cap-and-trade funds, delaying action on climate change

Greenhouse gas concentrations in the atmosphere continue to rise to dangerous levels, but still our political leaders delay taking meaningful actions to address the looming crisis. The latest example: Gov. Jerry Brown is borrowing $500 million from the state’s new cap-and-trade program — money designated specifically for efforts to address climate change — to help balance the revised state budget proposal that he released today.

And the worst part was that Brown is raiding these funds even though there was no good reason to do so. “The Governor’s Budget reflected California’s most stable fiscal footing in well over a decade,” was the first sentence in the budget document, which admirably begins to restore education funding, partly because voters approved the Prop. 30 tax package last year.

While Brown said that the $500 million raid is just a loan that will be paid back with interest, the action highlights the short-term thinking that animates our political and business leaders, who seem content with hollow gestures and symbolic actions that fall far short of what’s actually needed to minimize climate change and sea level rise (even the cap-and-trade system itself is a business-friendly half-measure; simply capping then decreasing emmissions would have been far more effective).

There are a multitude of immediate needs for that “borrowed” money that would have big impacts to the carbon emmissions that our state continues to spew into the atmosphere, such as helping Muni and other urban transit systems overcome budget deficits that hamper their ability to provide good alternatives to private automobile use, which is one of the top sources of greenhouse gas emmissions.  

Environmentalists and advocates for social and economic justice — who have fought to direct some of these funds to reducing emmissions in low-income communities, where it is an acute public health issue on top of the long-term climate change threat — immediately criticized the governor’s move.

“The governor is playing a dangerous game that could wreck California’s push toward clean energy,” Greenlining Institute Legal Counsel Ryan Young said in a press release. “Voters of color turned out in force to protect AB 32, the clean energy law, when it was under attack by Prop. 23 [last year’s effort to repeal it], and they did it based on the promise that it would bring clean energy investments to polluted and struggling communities. These are the same voters who provided Jerry Brown’s victory margin when he ran for governor. Seizing these funds for other uses will hurt our state’s neediest communities, and it’s simply not necessary.”

Longtime Sierra Club legislative director Bill Magavern, who works with the Coalition for Clean Air, told Capital Weekly that the money is urgently needed for a variety of programs to reduce pollution in communities of color: “These important goals are now shunted aside as broken promises. The Governor has spoken of the urgency of addressing our climate crisis, but he has not put his money where his mouth is. It’s important to remember that none of the dollars in the Greenhouse Gas Reduction Fund come from taxes, and they were never intended to go to the General Fund.”

Another gauge is also telling: how do the polluters feel about the governor’s new budget? Well, here’s another press release we got on the governor’s new budget, from a conservative business organization that has long opposed meaningful efforts to address climate change: “California Manufacturers & Technology Association president Jack Stewart made the following media statement after Gov. Jerry Brown’s proposed ‘May Revise’ budget: ‘We congratulate Gov. Jerry Brown on a proposed balanced budget that will help California provide important government services. We appreciate that the Governor proposes the addition of a statewide sales tax exemption on the purchase of manufacturing equipment.  This will make California a more competitive place to scale up production.”

Same as it ever was.

The zero-sum future

It’s going to take longer, sometimes, to get from here to there. Acres of urban space are going to have to change form. Grocery shopping will be different. Streets may have to be torn up and redirected. The rules for the development of as many as 100,000 new housing units in San Francisco will have to be rewritten.

That’s the only way this city — and cities across the country — can meet the climate-change goals that just about everyone agrees are necessary.

Jason Henderson, a geography professor at San Francisco State University, lays out that case in a new book. He argues, persuasively, that the era of easy “automobility” — a time when people could just assume the ease and convenience of owning and using a private car as a primary means of transportation — has come to an end.

Henderson isn’t suggesting that all private vehicles go away; there are places where cars and trucks will remain the only way to move people and supplies around. But in the urban and suburban areas where most Americans live, the automobile as the default option simply has to end.

“In 10 years, there will be less automobility,” he told me in a recent interview. “It’s a simple limit to resources.”

And the sooner San Francisco starts preparing for that, the better off the city and its residents are going to be.

 

BIG NUMBERS

Henderson’s book, Street Fight: The Politics of Mobility in San Francisco, focuses largely on the Bay Area. But as he points out, the lessons apply all over. The numbers are daunting: Cities, Henderson reports, “use 75 percent of the world’s energy and produce 78 percent of global greenhouse gas emissions.” He adds: “Transportation is the fastest growing sector of energy use and [greenhouse gas] emissions, and this fact is in great measure owing to the expansion of automobility.”

And the United States is the biggest culprit. This nation has 4 percent of the world’s population — and 21 percent of the world’s cars.

To turn around the devastating impacts of climate change, “America will need not only to provide leadership, but also to decrease its appetite for excessive, on demand, high-speed automobility.”

And buying a lot of Priuses, or even electric cars, isn’t going to do the job. “Americans must undertake a considerable restructuring of how they organize cities, and that must include the rethinking of mobility and the allocation of street space.”

The Bay Area is about to enter into a long-term planning cycle that, according to groups like the Association of Bay Area Governments, will involve increased urban density. ABAG, according to its most recent projections, would like to see some 90,000 new housing units in San Francisco.

That’s got plenty of problems — particularly the likelihood of the displacement of existing residents. Henderson agrees that more density is going to be needed in the Bay Area — but he’s surprisingly bullish on the much-denigrated suburb.

“It’s actually quick and easy to retrofit suburbia,” he told me.

And like so much of what he discusses in his book, the primary solution is the old, venerable, human-powered contraption known as the bicycle.

“Existing communities like Walnut Creek are eminently bikeable,” Henderson told me. He suggests expanding development in three-mile circles around BART stations — after getting rid of all the parking. “We could easily get 20 to 30 percent of the trips by bike,” he noted.

In fact, he argues, it’s easier to put bicycle lanes and paths in the suburbs than in San Francisco. The streets tend to be wider, there’s more room in general — and it’s fairly simple to provide barriers from cars that make biking safe for everyone.

In fact, a lot of European cities are less dense than San Francisco — and have far fewer drivers. Even in California, the city of Davis is famous for its bike culture; “In Davis,” Henderson said, “There are all these children riding their bikes to school.”

 

ACRES OF PARKING

One of the most profound changes San Francisco is going to have to make involves coming to terms with the immense amount of scarce space that’s devoted to cars. Parking spaces may not seem that big — but when you combine the 300-square-foot typical space (larger than many bedrooms and offices) with the space needed for getting into and out of that space, it adds up.

“Parking for 130 cars amounts to about an acre, and the aggregate of all non-residential off-street parking is estimated to be equal in area to several New England states.”

Cars need more than a home parking space — they need someplace to park when they’re used. So in a city like San Francisco that has more than 350,000 cars, a vast amount of urban land must be devoted to parking. In fact, Henderson estimates that parking space in San Francisco amounts to about 79.4 million square feet — or about 79,400 two-bedroom apartments. Off-street parking alone takes up space that could house 67,000 two-bedroom units.

And it’s hella expensive. Building parking adds as much as 20 percent to the cost of a housing unit. He cites studies showing that 20 percent more San Franciscans could afford to buy a condo unit if it didn’t include parking.

But the city still mandates off-street parking for all new residential construction — and while activists have managed to get the amount reduced from a minimum of one parking space per unit to a maximum of around eight spaces per 10 units, that’s still a whole lot of parking.

And if San Francisco is expected to absorb 90,000 more housing units, under current rules that’s 72,000 more cars — which means a demand for 72,000 more parking spaces near offices, shopping districts, and parks. Crazy.

So how do you get Americans, even San Franciscans, to give up what Henderson calls the “sense of entitlement that we can speed across town in a private car?” Some of it requires the classic planning measures of discouraging or banning parking in new development (AT&T Park works quite well as a facility that is primarily accessed by foot and transit). Some of it means putting in the resources to improve public transit.

And a lot of it involves shifting transportation modes to walking and bicycles.

San Francisco has had significant success increasing the use of bikes in the past few years. But there are limits to what you can do by tinkering around the edges, with a few more bike lanes here and there.

There are, for example, the hills. And there’s grocery shopping for a family. Those things need bigger shifts in the use of urban space.

San Francisco’s street grid, for example, sends travelers straight up some nearly impossible inclines. Young, healthy people in great physical condition can ride bikes up those hills, but children and older people simply can’t.

Henderson suggests that the city could install lifts in some areas, but there’s another, more radical (but less energy-intensive) solution: Reroute the grid.

If city streets wound around the sides of hills, instead of heading straight up, walking and biking would be far easier. That would involve major changes, particularly since there’s housing in the way of any real route changes — but in the long term, that sort of concept should, at least, be on the table.

Bikes with cargo trailers make a lot of sense for shopping, Henderson told me — and once big supermarkets get rid of all that parking, the price of food will come down.

 

THE POLITICS OF NEO-LIBERALS

The biggest challenge, though — and the heart of Henderson’s book — is political. Transportation, he argues, is inherently ideological: “It matters how you get from here to there.” And he notes that progressives, who are willing to think about social responsibility, not just individual rights, see the choices very differently than the neo-liberals, who in this city are often called “moderates.” If the neo-libs have their way, he says, the changes will be too little, too late, and mostly ineffective.

Because Americans are facing a series of choices — and there are no solutions that preserve the old way of life without sacrificing the future of the planet. It’s entirely a zero-sum game: We can slow global climate change, or we can keep driving cars. (Oh, and electric cars — which still require large amounts of power, mostly from fossil-fuel plants — aren’t going to solve the problem any time soon.)

We can shift to bicycles and transit as our primary ways to get around, or we can leave our kids an ecological disaster of unprecedented scope. We can overhaul the entire way we think about urban planning — to make streets friendly to bikes and buses — or we can go down a deadly path of no return.

We can accept the fact that moving around cities may be a little slower, particularly while we adapt. Or we can join the climate-change deniers. “There are a lot of neo-liberals out there who say we can’t start controlling automobility until we have a gold-plated transit system,” Henderson told me. “But this is not a chicken and egg problem. First you have to create the urban space. Then you can build a better system.”

Students celebrate SF resolution to divest from fossil fuels

Famed environmental writer and 350.org founder Bill McKibben wore a short-sleeved T-shirt as he stood on the steps of San Francisco City Hall this afternoon and addressed a crowd of energized student climate activists.

“It’s a pretty day here, but it’s a little warmer than it should be,” he remarked of the hot afternoon with temperatures creeping above 80 degrees F. “This is the hottest May 2 ever recorded in the city of San Francisco.”

McKibben was there to celebrate a recent victory for his organization’s fossil fuel divestment campaign, which came last week when the San Francisco Board of Supervisors voted to adopt a resolution by Sup. John Avalos urging the San Francisco Employee Retirement System to divest from companies that hold fossil fuel reserves.

McKibben’s organization, 350.org, has been urging colleges, universities and city governments across the country to enact similar measures. “This is pretty simple math. The math is, if you’re invested in the fossil fuel industry, then you are profiting from the wreckage of the climate,” McKibben said. You are making a bet that nothing will ever be done to stop or slow down climate change, because if anything ever is done, it will put those investments at risk. The perversity of that is stunning.”

Students across the country have organized campaigns to divest, borrowing a tactic from the anti-apartheid movement. Over the last couple days, “The students at the Rhode Island School of Design had gone and occupied their president’s office, because they were getting no attention to their demand for divestment,” McKibben noted. “And they dropped a banner out the window. And the banner said, ‘We may be art students, but we can still do the math.’”

He went on: “There’s no absolute guarantee that we’re going to win this fight. But I do know … that we’re at the very least going to fight. And fight hard.”

Sup. John Avalos also delivered comments at the rally. When he first contemplated introducing the resolution, “I thought, oh no, just another advisory measure that we’re going to do as a Board of Supervisors,” Avalos admitted, “but I also saw the real value of it. That if San Francisco could take a stand like this, it could have a real impact on all the other cities around the country.”

He added that the most compelling argument for divestment was that, “We know that we cannot take all of the fossil fuel out of the ground that those corporations are seeking. And eventually … they’ll be stranded assets that we’ll have no return on in the future.”

Asked after the rally whether he thought SFERS would indeed divest as a result of the nonbinding resolution, McKibben told the Bay Guardian, “I have no doubt that they will. … I think that that’s starting to happen all over the country, and I think people like Supervisor Avalos are serious about making sure that it’s for real. You know, in Washington we make rhetorical statements with nothing behind them, but hopefully in San Francisco,” things will turn out differently, he added.

Earlier in the day, Norm Nickels of SFERS noted that the resolution has not yet been added as an agenda item for the Retirement Board to take up, because it has not yet cleared the final hurdle for official Board of Supervisors approval.

Mason’s the co-director of the new HUB Oakland community-building center (www.huboakland.net), a partner in Earthseed Consulting, LLC (www.earthseedconsulting.com), which designs and promotes environmental projects with an emphasis on diversity, and a board member of the East Bay Meditation Center (www.eastbaymeditation.org). San Francisco Bay Guardian You’re both a yoga-meditation teacher and an environmental activist. How do these two aspects of your life intersect?

Konda Mason Yoga and meditation give you that time to pause and quiet the chatter in your head and connect to that place inside that is unchanging and feels connected to the whole. You feel the deep inner connectivity that you have with all things in those moments, that connection with all life.

SFBG One of your main efforts has been introducing the African American community to green practices.

KM Marginalized people in general are left out of every important conversation that affects them the most. It’s more about social economics than race. When we look at who is on the frontline of impact, it’s always the marginalized: women, children, youth, the poor, and people of color. I’m a filmmaker by trade, so when I became a part of Earthseed, the idea came to me to create an online series called “Green Street Loft,” a fun, accessible, and culturally relevant series for the African American audience. It hasn’t launched yet, but stay tuned.

SFBG Years ago, you were a founder of the International Association for Black Yoga teachers. Do you think diversity is increasing in the yoga community?

KM I do believe that people are seeing more and more diversity in general in areas around spiritual pursuits. These days, I also teach at Spirit Rock and help lead the annual People of Color meditation retreat. The thing to me that is lacking more than anything is men. Everything I do, the audience is always predominantly women! That is where the attention needs to be drawn.

SFBG And now you’re starting HUB Oakland. What is that?

KM The HUB is a global movement of people who are working on solutions to better the world. It’s a place where people can come and collaborate and meet each other and work together, a place for conversation and action to happen. It’s for social entrepreneurs, and for sustainable business ideas that need incubation to get to the next level. It exists on five different continents. San Francisco is the biggest and most successful HUB in the network. Now, HUB Oakland is starting.

SFBG How will HUB Oakland be different than other HUBs?

KM Every HUB takes on the personality of its city. HUB Oakland will probably be the most diverse HUB in the network in terms of ethnicity and ages. We will have workshops about personal growth and spiritual growth with people from Silicon Valley to Spirit Rock. Everybody is invited.

SFBG When will it open?

KM We have a building on Broadway between 23rd and 24th streets that we signed a lease on. We move there in October. It’s a 60,000-square foot space that is just beautiful. Until then, we’re in a pop-up place, a 2000-square foot old bank through the help of the City of Oakland and Popuphood (www.popuphood.com).

SFBG Tell us about the Earth Day event at Spirit Rock this weekend.

KM I’m looking forward to it. There will be some really key people there who are committed to environment and sustainability. The thing about this movement to “change the world” is that “change” and “transformation” are two different things. What’s lasting is transformation. It begins with the individual. We can window-dress something and make it look green, but if we haven’t transformed ourselves, it will revert back to the way it was. This is why the contemplative practices and wisdom traditions are so essential to sustainability. They foster change in the individual.
