Treasure Island development plans moving forward after lawsuit rejected

Construction on the first 1,000 of up to 8,000 new homes planned for Treasure Island could begin as soon as next year after the State Appeals Court this week rejected a challenge of the project’s environmental impact report by Citizens for a Sustainable Treasure Island, a grassroots group led by former supervisor Aaron Peskin.

The group challenged the project’s unanimous 2006 approval by the Board of Supervisors after its terms were modified the next year by the developers, Wilson Meany and Lennar Urban, to increase the number of homes and decrease their affordability. The project Peskin helped approve was 6,000 homes, 30 percent of them affordable, but now it’s up to 8,000 homes, 25 percent affordable.

More recently, stories by the Center for Investigative Reporting/Bay Citizen, San Francisco Chronicle, and others have also found evidence of lingering radiological contamination on the island from its days as a US Navy base, something that Peskin told us should raise concerns about the project.

“Obviously, we are disappointed in the court ruling and are very concerned it ignores the now widely reported news that Treasure Island is much more contaminated, by radiologically contamination, than we knew,” Peskin told us. As for whether his group intends to appeal the case to the California Supreme Court, he said, “We are assessing our options.”

Wilson Meany principle Chris Meany didn’t immediately return Guardian calls for comment (we’ll update this post if and when we hear back), but in a press release, he said, “After several years of unnecessary and costly litigation, we can finally begin building more homes for people who want to live in San Francisco.”

In addition to the homes, the project includes up to 500 hotel rooms, 450,000 square feet of retail space, 100,000 square feet of office space, and 300 acres of open space. To compensate for projections that rising seas caused by global warming would inundate the artificial island by the end of the century, its height will be raised substantially, with the EIR noting there will be about 100,000 trucks of landfill coming over the Bay Bridge during construction.

Traffic generated by the project has been a major concern of transportation officials from the beginning. San Francisco Transportation Authority Executive Director Tilly Chang said the challenge was, “How do you keep the Bay Bridge flowing and not muck up traffic?”

The plan calls for expanded bus and shuttle service to Treasure Island, new ferry service from the Ferry Building, and both expensive parking on the island for non-residents and a toll for driving onto the island, most likely set at $5, Chang said. The ferry service is set to launch around when the first phase of housing construction is complete, probably in 2018.

Meanwhile, work has already begun on a project to replace and improve the freeway ramps at adjacent Yerba Buena Island and the bridge that connects them to Treasure Island. SFTA Deputy Director for Capital Projects Lee Sage said the ramps will give much more time for cars to slow down or accelerate as they enter or exit the freeway there.

“It’s going to be very complicated, but we’re on target,” he said, estimating the eastside ramps will be done in 2016 and the westside ones a few years later.

Just last month, the Board of Supervisors approved terms accepting Treasure Island from the US Navy. Later this month  assuming that the issue of radiological contamination doesn’t derail the transfer — the city and project developers are scheduled to pay the Navy $55 million for Treasure Island and complete the deal.

But Peskin’s group and its attorney Keith Wagner, objected to the transfer in a June 25 letter to the Navy, calling for more studies on the substantially increased density of development on the island and more thorough testing and cleanup of contamination.

Wagner wrote, “In summary, the Navy’s 2003 EIS, on its own terms, did not evaluate the true nature of the City’s far more expansive contemporaneous development plans/proposals, let alone the even more expansive development plans that were ultimately devised and approved by the City in 2011; in the decade since the 2003 EIS was finalized, the Navy has developed significant and substantial new information indicating the nature, scope and severity of radiological and hazardous materials across NSTI that could impact the City’s 2011 development plans.”

Here’s an intriguing idea for Piers 30-32

Earlier this year, the Golden State Warriors abandoned its bid to construct a basketball arena and performance venue at Piers 30-32 along San Francisco’s waterfront, a proposal Mayor Ed Lee once championed as his “legacy project.”

The Warriors moved its ambitious project to a site in Mission Bay, to the great relief of a group of waterfront activists who viewed it as an inappropriate choice for the unique and historic 7.5-mile stretch of city waterfront that falls under the jurisdiction of the Port of San Francisco.

Nevertheless, that shift did send the Port back to the drawing board with the problem it’s encountered numerous times before: What to do with Piers 30-32, which span a 13-acre slab of crumbling concrete currently in use as a parking lot just a stone’s throw from the Bay Bridge.

In a recent Bay Guardian editorial, we called for a public process to consider the future use of that waterfront pier. Could it be turned into open space? Removed? Converted to a different use?

Turns out, others have been contemplating the same question. The San Francisco Civil Grand Jury, a volunteer body tasked with investigating civic matters, introduced a new idea when it issued a report on the operations of the Port of San Francisco.

Titled, “The Port of San Francisco: Caught Between Public Trust and Private Dollars,” the Civil Grand Jury report raised a few incisive questions, going so far as to suggest that the Port operates with undue influence from the Mayor’s Office, and that its governing commission ought to be restructured to resolve that. We are going to drill down more on these issues in a different post, after we’ve had a chance to interview a spokesperson from the Port.

But for now, here’s the Civil Grand Jury’s line on Piers 30-32: Why not look into using it as the site of a marine research institute?

From the report:

“Our suggestion is to investigate the possibility of building a Marine Research Institute on the pier. The project lead could be an educational institution such as Woods Hole Oceanographic Institution or Scripps Institute of Oceanography (UC San Diego), a conservation group such as Cousteau Society, Greenpeace, or Ocean Conservancy, or even  government based groups such as National Oceanic and Atmospheric Administration (NOAA) or United Nations Educational, Scientific and Cultural Organization (UNESCO).

“With close proximity to the Gulf of the Farallones, Cordell Bank, and Monterey Bay National Marine Sanctuaries to the west and the Sacramento-San Joaquin Delta to the east, a San Francisco Bay location presents a unique opportunity for marine and estuary study.

“The Cordell Bank and Gulf of the Farallones Sanctuaries today cover about 1800 square miles, but the proposed addition by NOAA will add an additional 2,000 square miles extending north.

“Funding could be derived not only from the sources mentioned above, but it may be possible to get donations from charitable foundations, such as Ford Foundation or Paul Getty Trust, and supplement large contributions by forming a coalition of the dozens of smaller advocacy and conservation groups—a form of crowd-funding on a large scale.”

A waterfront research institute that could aid scientists in studying the effects of climate change on ocean ecosystems? It couldn’t be farther from the sexy, spaceship-shaped sports arena previously proposed for that waterfront site. But it might not be such a bad idea.

Peculiar thrills

FILM Documentaries are often the best section of any given film festival. But even die-hard fans admit to occasional Social Issue Fatigue — that feeling you get when you’ve just seen too many all-too-convincing portraits of real life injustices, reasons why the planet is dying, etc. “It was great — I’ll just go kill myself now” is a reaction few want to experience, you know, three times in one day. Yet it’s a typical plaint heard on queue at events like Toronto’s Hot Docs, let alone the touring United Nations Association Film Festival (a virtual global wrist-slitting orgy).

You’d be hard-pressed to have such a hard time at our own SF DocFest, however. For 13 years it’s managed to emphasize the entertaining and eccentric over grim reportage. To be sure, the latest edition, opening Thu/5 (with programs primarily at the Roxie and Oakland School for the Arts) has its share of films on topically important subject themes. Centerpiece presentation The Internet’s Own Boy: The Story of Aaron Swartz poignantly recalls the short history of the brilliant young programmer-activist whose fate is especially chilling given the potential imminent death of net neutrality. Of Kites and Borders examines the harsh lives of children in the Tijuana area; Goodbye Gauley Mountain has Bay Area “eco-sexuals” Annie Sprinkle and Beth Stephens uniquely protesting the mountaintop removal industry in the Appalachians. But among 2014 SF DocFest’s 40 or so features, only Ivory Tower — about the increasingly high cost of higher U.S. education — offers straight-up journalistic overview of an urgent social issue.

More typical of DocFest’s sensibility are its numerous portraits of peculiar individuals and even more peculiar obsessions. In the jobs-make-the-man department, there’s An Honest Liar, whose magician subject The Amazing Randi has made it his personal mission to expose those who’d use his profession’s tricks to defraud the vulnerable; The Engineer, profiling the sole criminologist working in gang crime-ridden El Salvador; Bronx Obama, in which one man’s uncanny resemblance to the POTUS sets him on a lucrative but discomfiting career of impersonation for (mostly) audiences of hooting conservatives; and Vessel, whose protagonist Dr. Rebecca Gomperts sails the world trying to make abortions available to women whose countries ban the procedure.

There are no less than three features about people trying to succeed among the professionally tough: Fake It So Real (the South’s independent pro wrestling circuit), Bending Steel (a Coney Island performing strongman) and Glena (struggling mother hopes to hit paydirt as a cage fighter).

On the obsessive side, Wicker Kittens examines the world of competitive jigsaw puzzling. Jingle Bell Rocks! examines the netherworld of serious Christmas-music aficionados; Vannin’ observes the 1970s customized-van culture still alive today. Magical Universe is Jeremy Workman’s very first-person account of his friendship with an elderly Maine widower who turns out to have secretly created epic quantities of bizarre Barbie-related art. Hairy Who and the Imagists recalls the somewhat less “outsider”-ish achievements of Chicago’s ’60s avant-garde art scene, while Amos Poe’s 1976 The Blank Generation, DocFest 13’s sole archival feature, flashes back to punk’s birth throes at CBGB’s.

Another legendary moment is remembered in Led Zeppelin Played Here, about an extremely early, ill-received 1969 Zep show at a Maryland youth center that few attended, but many claim to have. Portraits of artists expanding their forms in the present tense include Trash Dance (a choreographer collaborates with truckers and their big rigs) and When My Sorrow Died (theremin!).

Exerting a somewhat wacked fascination is the cast of We Always Lie to Strangers, which is somewhat spotty and unfocused as an overall picture of tourist mecca Branson, Mo. — Vegas for people who don’t sin — but intriguing as a study of showboy/girl types stuck in a milieu where gays remain closeted and Broadway-style divas need to keep that bitching hole shut 24/7. Further insight into your entertainment options is provided by Doc of the Dead (on zombiemania) and self-explanatory Video Games: The Movie.

One pastime nearly everyone pursues — looking for love — gets sobering treatment in Love Me, one of several recent documentaries probing the boom in Internet “mail order brides” from former Soviet nations. Its various middle-aged sad sacks pursuing much younger Eastern bombshells mostly find themselves simply ripped off for their troubles. Those looking for quicker, cheaper gratification may identify with Back Issues: The Hustler Magazine Story.

Of particular local interest is the premiere of Rick Prelinger’s No More Road Trips, culled from his collection of nearly 10,000 vintage home movies. A preview screening of First Friday offers a first peek at this forthcoming documentary about tragic violence at the monthly arts festival in Oakland last year. True Son follows 22-year-old Michael Tubbs’ attempt to win a City Council seat and reverse the fortunes of his beleaguered native Stockton. The “Don’t Call It Frisco!” program encompasses shorts about the Bay Bridge troll, a Santa Rosa animal “retirement home,” and a salute to South Bay hardcore veterans Sad Boy Sinister.

DocFest ends June 19 with that rare thing, a documentary about downbeat, hard-to-encapsulate material that’s won considerable attention simply because it’s so beautifully crafted and affecting. Andrew Droz Palermo and Tracy Droz Tragos’ Rich Hill focuses on three kids in worse-than-average circumstances in a generally depressed Missouri town of 1,400 souls. Harley is an alarmingly temperamental teen housed on thin ice with his grandmother while his mother sits in prison for reasons that explain a great deal about him. Potty-mouthed Appachey is a little hellion perpetually setting off his exasperated, multi-job-juggling single mother, living in near-squalor.

Still, both are at least superficially better off than Andrew, an almost painfully resilient and hopeful boy constantly uprooted by an obscurely damaged mother and a father who can’t hold a job to save his life. “We’re not trash, we’re good people,” he tells us early on, later rationalizing his continuing dire straits with “God must be busy with everyone else.” He’s the heartbreaking face of a hardworking, religious, white American underclass that is being betrayed into desperation by the politicians who claim to share its values.

Citizen Agnos comes on strong for Proposition B in support of his Athenian oath

When Art Agnos was sworn in as mayor in 1988, he used the Athenian Oath that was taken by young men reaching the age of majority in Athens 2000 years ago.  He shortened the oath (as many did) to say: “I promise…upon my honor…to leave my city better than I found it.”

For Agnos, a Greek steeped in Greek traditions, the oath was a serious matter. “At the heart of our vision,” Agnos said in his inaugural address, “ is a refusal to let San Francisco become an expensive enclave  that locks out the middle class, working families and the poor. At the center of our strategy is a belief in the basic right of people to decent jobs and housing.”  

Twenty-six years later, Citizen Agnos was working hard  in private life to leave his city better than he had found it. He led a citizens’ movement that stopped the monstrous 8 Washington project, knocked the Warriors off the piers, forced the Giants to lower their  highrise expectations,  and promoted Proposition  B that would stop  the Wall on the Waterfront and require a public vote on any increases  to current height limits on port property.

 And Agnos is having the time of his life doing all this, as he made clear in his remarks to San Francisco Tomorrow, the one organization in town that has been manning the barricades in every major Manhattanization battle all these years  on the waterfront and everywhere else.  He enjoys taking on Mayor Lee and “the high tech billionaire political network that wants to control city hall and fulfill their vision of who can live here and where.” And he must relish  the Chronicle’s C.W.Nevius and the paper’s editors and their self-immolating bouts of hysteria.  

Agnos gave a splendid speech and confirms that he really is our best ex-mayor. I particularly liked his point about the “power to decide” on development. “Today that power to decide is in a room In City Hall. I know that room. I have been in that room. 

“You know who is in there? It is the lobbyists,..the land use lawyers…the construction union representatives..the department directors..and other politicians. You know who is not in that room. You.Prop B changes that dynamic and puts you in the room that matters. No more ‘advisory committees’ that get  indulged and brushed off. No more ‘community outreach’ that is ignored. It will all matter.”

Yes, yes, yes, a thousand times yes, on B and stopping the Manhattanization of the waterfront. b3

Agnos remarks to San Francisco Tomorrow 

I am delighted to speak to the members and friends of SFT about the waterfront tonight…and a special shout out to Jane Morrison as one of the pioneer professional  women in the media… and one of the  finest Social Service Commissioners in our City’s history. I also welcome the opportunity to join you in honoring tonight’s unsung heroes…Becky Evans with whom I have worked closely over the past year and half …Tim Redmond  the conscience of the progressive community for the past 35 years…Sarah Short and Tommi Avicolli Mecca from the Housing Rights Committee who stand up every day for poor and working people who need a voice in our city.

Twenty-four years ago in 1990, I made one of the best decisions of my mayoralty when I listened to the progressive environmental voice of San Francisco and ordered the demolition of the Embarcadero Freeway. That freeway was not only a hideous blight but also a wall that separated the city from its waterfront. Hard to believe today…but it was a very controversial decision back then… just 3 years before…in 1987 the voters had defeated a proposal by Mayor Feinstein to demolish it. The Loma Prieta Earthquake gave us a chance to reconsider that idea in 1990. Despite opposition of 22,000 signatures on a petition to retrofit the damaged freeway… combined with intense lobbying from the downtown business community led by the Chamber of Commerce, North Beach, Fisherman’s Wharf and especially Chinatown…we convinced the Board of Supervisors to adopt our plan to demolish the freeway… by one vote.

And the rest is history…until today. 

After a period of superb improvements that include a restored Ferry Building…the Ball park… new public piers where one can walk further out into the bay than ever before in the history of this city… the 
Exploratorium…the soon to be opened Jim Herman Cruise Ship terminal…Brannan Wharf Park…there is a new threat. Private development plans that threaten to change the environment of what Herb Caen first called “our newest precious place” …not with an ugly concrete freeway wall…but with steel and glass hi-rises that are twice as tall.

Today…the availability of huge amounts of developer financing …combined with unprecedented influence in city hall and the oversight bodies of this city…the Waterfront has become the new gold coast of San Francisco. Politically connected developers seek to exploit magnificent public space with hi-rise, high profit developments that shut out the ordinary San Franciscan from our newest precious place. We love this city because it is a place where all of us have a claim to the best of it…no matter what our income…no matter that we are renter or homeowner…no matter what part of the city we come from.

And connected to that is the belief that waterfront public land is for all of us…not just those with the biggest bank account or most political influence. 

That was driven home in a recent call I had from a San Franciscan who complained about the high cost of housing for home ownership or rent…the high cost of Muni…museum admissions…even Golden Gate Bridge tours and on and on. When he finished with his list, I reminded him I was mayor 23 years ago and that there had been 4 mayors since me,  so why was he complaining to me?
“Because you are the only one I can reach!” he said.

Over the past few weeks…that message has stuck with me.  And I finally realized why. This is what many people in our city have been seeking… someone who will listen and understand. Someone who will listen…understands… and acts to protect our newest precious place…our restored waterfront. You see…it was not just about luxury high-rise condos at 8 Washington last year…It was not just a monstrous 
basketball arena on pier 30-32 with luxury high-rise condos and a hotel across the street on public land. It’s about the whole waterfront that belongs to the people of San Francisco…all 7 and half miles of it… from the Hyde Street Piers to India Basin. And it must be protected from the land use mistakes that can become irrevocable. 

This is not new to our time…8 Washington and the Warriors arena were not the first horrendous proposals…they were only the latest. Huge… out of scale… enormously profitable projects… fueled by exuberant boosterism from the Chamber of Commerce… have always surfaced on our waterfront. 50 years ago…my mentor in politics…then Supervisor Leo McCarthy said, “We must prevent a wall of high rise apartments along the waterfront…and we must stop the filling in of the SF bay as a part of a program to retain the things that have made this city attractive.” That was 1964…

In 2014…Former Board of Supervisors President Aaron Peskin said it best this way…”It seems like every 10 years…every generation has to stand up to some huge development that promises untold riches
  as it seeks to exploit the waterfront and our public access to it.” Public awareness first started with the construction of the 18 stories of Fontana towers east and west in 1963. That motivated then Assemblyman Casper Weinberger to lead public opposition and demand the first height limits… as well as put a stop to 5 more Fontana style buildings on the next block at Ghirardelli Square. This was the same Casper Weinberger who went on to become Secretary of HEW and Secretary of Defense under President Ronald Reagan.

In 1970 the Port Commission proposed to rip out the then “rotting piers” of piers 1 – 7 just north of the Ferry Building. They were to be replaced with 40 acres of fill (3 X Union Square) upon which a 1200-room hotel and a 2400 car garage would be built. It passed easily through Planning and the Board of Supervisors. When the proposal was rejected on 22 to 1 vote by BCDC, Mayor Alioto complained, “We just embalmed the rotting piers.” No… we didn’t …we saved them for the right project…and if one goes there today… they see it…the largest surviving renovated piers complex with restaurants, walk in cafes, port offices, free public docking space, water taxis and complete public access front and back. 

In 2002… that entire project was placed on the U.S. National Historic Register. But my favorite outrageous proposal from that time was the plan to demolish another set of “rotting piers” from the Ferry Building south to the Bay Bridge. And in place of those rotting piers… the plans called for more landfill to create a Ford dealership car lot with 5000 cars as well as a new Shopping center. That too…was stopped.

So now it’s our turn to make sure that we stop these all too frequent threats to the access and viability of our waterfront.

In the past 2 weeks…we have seen momentum grow to support locating the George Lucas Museum on piers 30-32 or the sea wall across the Embarcadero.I love the idea…but where would we be with that one be if a small band of waterfront neighbors and the Sierra Club had not had the courage to stand up to the Warriors and City Hall 2 years ago. Once again they used the all too familiar refrain of “rotting piers” as an impending catastrophe at piers 30-32.

Proposition B will help prevent mistakes before they happen. Most of all… Prop B will ensure protection of the port on more permanent basis by requiring a public vote on any increases to current height limits on Port property.All of the current planning approval processes will stay in place…Port Commission…Planning commission…Board of Permit Appeals…Board of Supervisors…will continue to do what they have always done. But if a waiver of current height limits along the waterfront is granted by any of those political bodies…it must be affirmed by a vote of the people. Prop B does not say Yes or No…it says Choice. It is that simple. The people of SF will make the final choice on height limit increases on port property. 

The idea of putting voters in charge of final approval is not new. In the past the people of San Francisco have voted for initiatives to approve a Children’s budget…a Library budget…retaining neighborhood fire stations… minimum police staffing… as well as require public authorization for new runway bay fill at our airport. And at the port itself… there have been approximately 18 ballot measures to make land use and policy decisions.

So…we are not talking about ballot box planning…we are talking about ballot box approval for waivers of existing height limits on public property. Opponents like Building Trades Council, Board of Realtors, 
and Chamber of Commerce are raising alarms that we will lose environment protections like CEQA by creating loopholes for developers. 
Astonishing! 

Prop B is sponsored by the Sierra Club…Tonight we honor Becky Evans of the Sierra Club who sponsored Proposition B. That same set of opponents are joined by city bureaucrats issuing “doomsday” reports stating that we will lose thousands of units of middle class housing… billions of dollars in port revenues…elimination of parks and open space on the waterfront. Astonishing!

These are the same bureaucrats who issued glowing reports a couple of years ago that the America’s Cup would mean billions in revenue for the port and the city. And they wanted to give Oracle’s Larry Ellison 66-year leases to develop on 5 of our port piers for that benefit! Now…how did THAT work out? So far…city hall will admit to $11 million dollars in known losses for the taxpayers.

Another opponent… SPUR says any kind of housing will make a difference and there are thousands in the pipe line… so don’t worry.
Astonishing!

We have not seen one stick of low income or affordable housing proposed on the waterfront since the 80s and 90s when Mayor Feinstein and I used waterfront land for that very purpose. Hundreds of low-income housing dwellings like Delancey Street and Steamboat Point Apartments…affordable and middle class housing like South Beach Marina apartments and Bayside village comprise an oasis of diversity and affordable housing in the midst of ultra expensive condos. For me…that was part of an inaugural promise made in January 1988…I said, “At the heart of our vision is a refusal to let San Francisco become an expensive enclave that locks out the middle class, working families and the poor. At the center of our strategy is a belief in the basic right of people to decent jobs and housing. 

Yes…that was the commitment on public land on the waterfront by 2 mayors of a recent era… but not today. Indeed…San Francisco has been rated the #1 least affordable city in America…including NY Manhattan. That is one of the many reasons we see middle class  people…as well as working poor…being forced to leave San Francisco for Oakland and elsewhere in the bay area. That reality was reinforced in the February 10, 2014 issue of Time Magazine…Mayor Lee said, “I don’t think we paid any attention to the middle class. I think everybody assumed the middle class was moving out.”

Today…An individual or family earning up to $120,000 per year …150 per cent of the median in this city… do not qualify for a mortgage and can’t afford the rent in one of the thousands of new housing units opening in the city. The Chronicle reported a couple of weeks ago that a working family of  3 who have lived in a rent-controlled studio apartment in the Mission is offered $50 K to leave. That is what the purely developer driven housing market offers. And that philosophy is reinforced by a planning commission whose chair was quoted in December 2013 issue of SF Magazine saying, “Mansions are as just as important as housing.”

Prop B changes that dynamic by putting the Citizen in the room with the “pay to play” power brokers. That is what it is all about my friends. Power.

Former SF city planning director and UC School of City Planning Professor…Alan Jacobs recently related what he called the Jacobs Truism of land economics: “Where political discretion is involved in land use decisions…the side that wins is the side with the most power. And that side is the side with the most money.” Prop B will ensure that if developers are going to spend a lot of money to get a height waiver on port property …the best place to spend it will be to involve, inform, and engage the citizen as to the merit of their request…not on the politicians.

Today that power to decide is in a room in City Hall. I know that room…I have been in that room. You know who is there? It is the lobbyists…the land use lawyers…the construction union representatives…the departmental directors… and other politicians. You know who is not in the room? YOU. The hope is that someone in that room remembers you. But if you really want your voice to be heard…you have to go to some departmental hearing or the Board of Supervisors…wait for 3 or 4 hours for your turn… and then get 2 minutes to make your case. Prop B changes that dynamic and puts you in the room that matters. No more “advisory committees” that get indulged and brushed off. No more “community outreach” that is ignored. 

It will all matter. That is why today there is no opposition from any waterfront developer…They get it. We are going to win. It is easy to see how the prospect of Prop B on the ballot this June has changed the dynamics of high-rise development along the waterfront. The Warriors have left and purchased a better location on private land in Mission Bay. The Giants have publicly announced that they will revise their plans with an eye to more appropriate height limits on port land. Forest City is moving with a ballot proposal to use Pier 70 to build new buildings of 9 stories…the same height as one of current historic buildings they will preserve on that site for artists.

The Pier 70 project will include 30 percent low-income…affordable and middle class housing on site… along with low-tech industries, office space and a water front promenade that stretches along the entire shoreline boundary. A good project that offers what the city needs will win an increase in height limits because it works for everybody. A bad one will not. My friends…I have completed my elected public service career. There will be no more elections for me.

And as I review my 40 years in public life…I am convinced of one fundamental truth. The power of the people should… and must… determine what kind of a city this will be. It must not be left to a high tech billionaire political network that wants to control city hall to fulfill their vision of who can live here and where. It starts with you… the people of this city’s neighborhoods… empowered to participate in the decisions that affect our future. You are the ones who must be vigilant and keep faith with values that make this city great. This city is stronger when we open our arms to all who want to be a part of it…to live and work in it…to be who they want to be…with whomever they want to be it with. Our dreams for this city are more powerful when they can be shared by all of us in our time…

We are the ones …here and now… who can create the climate to advance the San Francisco dream to the next generation. And the next opportunity to do that will be election day 
June 3. Thank you.

Agnos offers waterfront development history lesson during SFT speech

[Editor’s Note: This is the text of a speech that former Mayor Art Agnos gave at San Francisco Tomorrow’s annual dinner on May 21. We reprint it here in its entirely so readers can hear directly what Agnos has been saying on the campaign trail in support of Prop. B]

I am delighted to speak to the members and friends of SFT about the waterfront tonight…and a special shout out to Jane Morrison as one of the pioneer professional women in the media and one of the finest Social Service Commissioners in our City’s history.

I also welcome the opportunity to join you in honoring tonight’s unsung heroes: Becky Evans, with whom I have worked closely over the past year and half; Tim Redmond, the conscience of the progressive community for the past 35 years; and Sara Shortt and Tommi Avicolli Mecca from the Housing Rights Committee, who stand up every day for poor and working people who need a voice in our city.

Twenty-four years ago, in 1990, I made one of the best decisions of my mayoralty when I listened to the progressive environmental voice of San Francisco and ordered the demolition of the Embarcadero Freeway. That freeway was not only a hideous blight but also a wall that separated the city from its waterfront.

Hard to believe today, but it was a very controversial decision back then. Just three years before, in 1987, the voters had defeated a proposal by Mayor Feinstein to demolish it. The Loma Prieta Earthquake gave us a chance to reconsider that idea in 1990.

Despite opposition of 22,000 signatures on a petition to retrofit the damaged freeway, combined with intense lobbying from the downtown business community led by the Chamber of Commerce, North Beach, Fisherman’s Wharf, and especially Chinatown, we convinced the Board of Supervisors to adopt our plan to demolish the freeway, by one vote.

And the rest is history — until today.

After a period of superb improvements — that include a restored Ferry Building, the ball park, two new public piers where one can walk further out into the bay than ever before in the history of this city, the Exploratorium, the soon to be opened Jim Herman Cruise Ship Terminal, Brannan Wharf Park — there is a new threat.

Private development plans that threaten to change the environment of what Herb Caen first called “our newest precious place,” not with an ugly concrete freeway wall, but with steel and glass high-rises that are twice as tall. Today, the availability of huge amounts of developer financing, combined with unprecedented influence in City Hall and the oversight bodies of this city, the waterfront has become the new gold coast of San Francisco.

Politically connected developers seek to exploit magnificent public space with high-rise, high profit developments that shut out the ordinary San Franciscan from our newest precious place. We love this city because it is a place where all of us have a claim to the best of it, no matter what our income, no matter that we are renter or homeowner, no matter what part of the city we come from.

And connected to that is the belief that waterfront public land is for all of us, not just those with the biggest bank account or most political influence. That was driven home in a recent call I had from a San Franciscan who complained about the high cost of housing for home ownership or rent, the high cost of Muni, museum admissions, even Golden Gate Bridge tours, and on and on.

When he finished with his list, I reminded him I was mayor 23 years ago and that there had been four mayors since me, so why was he complaining to me? “Because you are the only one I can reach!” he said.

Over the past few weeks, that message has stuck with me. And I finally realized why. This is what many people in our city have been seeking, someone who will listen and understand. Someone who will listen, understands, and acts to protect our newest precious place, our restored waterfront.

You see, it was not just about luxury high-rise condos at 8 Washington last year. It was not just a monstrous basketball arena on Pier 30-32 with luxury high-rise condos and a hotel across the street on public land. It’s about the whole waterfront that belongs to the people of San Francisco, all seven and a half miles of it, from the Hyde Street Piers to India Basin. And it must be protected from the land use mistakes that can become irrevocable.

This is not new to our time: 8 Washington and the Warriors arena were not the first horrendous proposals, they were only the latest. Huge, out of scale, enormously profitable projects, fueled by exuberant boosterism from the Chamber of Commerce, have always surfaced on our waterfront.

Fifty years ago, my mentor in politics, then-Supervisor Leo McCarthy said, “We must prevent a wall of high rise apartment along the waterfront, and we must stop the filling in of the SF bay as a part of a program to retain the things that have made this city attractive.”

That was 1964. In 2014, former Board of Supervisors President Aaron Peskin said it best this way: “It seems like every 10 years, every generation has to stand up to some huge development that promises untold riches as it seeks to exploit the waterfront and our public access to it.”

Public awareness first started with the construction of the 18 stories of Fontana towers east and west in 1963. That motivated then-Assemblyman Casper Weinberger to lead public opposition and demand the first height limits, as well as put a stop to five more Fontana-style buildings on the next block at Ghirardelli Square. This was the same Casper Weinberger who went on to become Secretary of HEW [formerly the Department of Health, Education, and Welfare] and Secretary of Defense under President Ronald Reagan.

In 1970, the Port Commission proposed to rip out the then “rotting piers” of Piers 1 – 7 just north of the Ferry Building. They were to be replaced with 40 acres of fill (three times the size of Union Square) upon which a 1200-room hotel and a 2400 car garage would be built.

It passed easily through Planning and the Board of Supervisors. When the proposal was rejected on 22 to 1 vote by BCDC [the San Francisco Bay Conservation and Development Commission], Mayor Alioto complained, “We just embalmed the rotting piers.”

No, we didn’t, we saved them for the right project. And if one goes there today, they see it, the largest surviving renovated piers complex with restaurants, walk-in cafes, Port offices, free public docking space, water taxis, and complete public access front and back. In 2002, that entire project was placed on the U.S. National Historic Register.

But my favorite outrageous proposal from that time was plan to demolish another set of “rotting piers” from the Ferry Building south to the Bay Bridge. And in place of those rotting piers, the plans called for more landfill to create a Ford dealership car lot with ,5000 cars as well as a new shopping center. That too was stopped.

So now it’s our turn to make sure that we stop these all too frequent threats to the access and viability of our waterfront. In the past two weeks, we have seen momentum grow to support locating the George Lucas Museum on Piers 30-32 or the sea wall across the Embarcadero.

I love the idea, but where would we be with that one if a small band of waterfront neighbors and the Sierra Club had not had the courage to stand up to the Warriors and City Hall two years ago. Once again, they used the all too familiar refrain of “rotting piers” as an impending catastrophe at Piers 30-32.

Proposition B will help prevent mistakes before they happen. Most of all, Prop. B will ensure protection of the Port on a more permanent basis by requiring a public vote on any increases to current height limits on Port property. All of the current planning approval processes will stay in place — Port Commission, Planning Commission, Board of Permit Appeals, Board of Supervisors, all will continue to do what they have always done.

But if a waiver of current height limits along the waterfront is granted by any of those political bodies, it must be affirmed by a vote of the people. Prop B does not say Yes or No, it says Choice. It is that simple. The people of SF will make the final choice on height limit increases on Port property.

The idea of putting voters in charge of final approval is not new. In the past, the people of San Francisco have voted for initiatives to approve a Children’s budget, a Library budget, retaining neighborhood fire stations, minimum police staffing, as well as to require public authorization for new runway bay fill at our airport. And at the Port itself, there have been approximately 18 ballot measures to make land use and policy decisions.

So we are not talking about ballot box planning, we are talking about ballot box approval for waivers of existing height limits on public property. Opponents like Building Trades Council, Board of Realtors, and Chamber of Commerce are raising alarms that we will lose environment protections like CEQA by creating loopholes for developers. Astonishing!

Prop B is sponsored by the Sierra Club. Tonight we honor Becky Evans of the Sierra Club who sponsored Proposition B. That same set of opponents are joined by city bureaucrats issuing “doomsday” reports stating that we will lose thousands of units of middle class housing, billions of dollars in Port revenues, elimination of parks and open space on the waterfront. Astonishing!

These are the same bureaucrats who issued glowing reports a couple of years ago that the America’s Cup would mean billions in revenue for the Port and the city. And they wanted to give Oracle’s Larry Ellison 66-year leases to develop on five of our Port piers for that benefit! Now, how did THAT work out? So far, City Hall will admit to $11 million in known losses for the taxpayers. Another opponent, SPUR [San Francisco Planning and Urban Research Association], says any kind of housing will make a difference and there are thousands in the pipeline, so don’t worry. Astonishing!

We have not seen one stick of low income or affordable housing proposed on the waterfront since the ‘80s and ‘90s when Mayor Feinstein and I used waterfront land for that very purpose. Hundreds of low-income housing dwellings like Delancey Street and Steamboat Point Apartments, affordable and middle class housing like South Beach Marina apartments and Bayside village, comprise an oasis of diversity and affordable housing in the midst of ultra expensive condos.

For me, that was part of an inaugural promise made in January 1988. I said, “At the heart of our vision is a refusal to let San Francisco become an expensive enclave that locks out the middle class, working families, and the poor. At the center of our strategy is a belief in the basic right of people to decent jobs and housing.”

Yes, that was the commitment on public land on the waterfront by two mayors of a recent era, but not today. Indeed, San Francisco has been rated the #1 least affordable city in America, including NY Manhattan. That is one of the many reasons we see middle class people, as well as working poor, being forced to leave San Francisco for Oakland and elsewhere in the Bay Area.

That reality was reinforced in the February 10, 2014 issue of Time Magazine. Mayor Lee said, “I don’t think we paid any attention to the middle class. I think everybody assumed the middle class was moving out.”

Today, an individual or family earning up to $120,000 per year — 150 percent of the median in this city — does not qualify for mortgage and can’t afford the rent in one of the thousands of new housing units opening in the city. The Chronicle reported a couple of weeks ago that a working family of three who have lived in a rent-controlled studio apartment in the Mission was offered $50,000 to leave.

That is what the purely developer-driven housing market offers. And that philosophy is reinforced by a Planning Commission whose chair was quoted in December 2013 issue of SF Magazine saying, “Mansions are just as important as housing.”

Prop B changes that dynamic by putting the citizen in the room with the “pay to play” power brokers. That is what it is all about my friends: Power.

Former SF city planning director and UC School of City Planning Professor Alan Jacobs recently related what he called the Jacobs Truism of land economics: “Where political discretion is involved in land use decisions, the side that wins is the side with the most power. And that side is the side with the most money.”

Prop B will ensure that if developers are going to spend a lot of money to get a height waiver on Port property, the best place to spend it will be to involve, inform, and engage the citizen as to the merit of their request, not on the politicians. Today that power to decide is in a room in City Hall. I know that room. I have been in that room.

You know who is there? It is the lobbyists, the land use lawyers, the construction union representatives, the departmental directors, and other politicians. You know who is not in the room? You. The hope is that someone in that room remembers you.

But if you really want your voice to be heard, you have to go to some departmental hearing or the Board of Supervisors, wait for three or four hours for your turn, and then get two minutes to make your case. Prop B changes that dynamic and puts you in the room that matters. No more “advisory committees” that get indulged and brushed off. No more “community outreach” that is ignored.

It will all matter. That is why today there is no opposition from any waterfront developer. They get it. We are going to win. It is easy to see how the prospect of Prop B on the ballot this June has changed the dynamics of high-rise development along the waterfront.

The Warriors have left and purchased a better location on private land in Mission Bay. The Giants have publicly announced that they will revise their plans with an eye to more appropriate height limits on Port land. Forest City is moving with a ballot proposal to use Pier 70 to build new buildings of nine stories, the same height as one of current historic buildings they will preserve on that site for artists.

Bay Guardian Community Forum! Bikes, buses, and budgets: How to create the transportation system San Franciscans need

Join the San Francisco Bay Guardian as we explore the current swirl of challenges and initiatives that will determine how people get around San Francisco. We’ll discuss transportation funding measures recently placed on the fall ballots this year and in 2016, big ideas such as tearing down I-280 and taking a Bay Bridge deck for bikes and buses, and the gap between political rhetoric and realities on the street along with a panel of key experts and activists. This is a free community event, and attendees will be entered into a raffle for an A2B electric bicycle, with a winner selected at the end of the event.

Supervisor Scott Wiener — Wiener represents San Francisco’s Supervisorial District 8 (Castro, Upper Market) and he has taken the lead role on the Board of Supervisors and Metropolitan Transportation Commission in advocating for dedicated funding sources for transportation project and challenging his colleagues to get serious about the challenges we face.

Professor Jason Henderson — As a geography professor at San Francisco State University, Henderson has focused his research and teaching on urban transportation issues. He’s also the author of Street Fight: The Politics of Mobility in San Francisco and he writes the Guardian’s popular and controversial monthly Street Fight column.

Chema Hernández Gil — Hernández Gil is a community organizer with the San Francisco Bicycle Coalition, San Francisco largest member-based grassroots advocacy organization, which has recently been highlighting funding shortfalls in creating the bicycling infrastructure needed to accommodate a growing number of cyclists. 

Susan King — King coordinates the popular Sunday Streets program, which creates temporary car-free spaces in San Francisco, the latest endeavor in a long history of transportation activism ranging from working for Livable City to helping found WalkSF to serving on the city’s Bicycle Advisory Committee to working on transit justice campaigns.

STREET FIGHT

San Francisco — already overwhelmed with private automobiles — faces a grim future of gridlock unless there is a radical change in how we think about city streets, parking, and regional transportation.

The facts are clear. Every day there are 1.7 million private car trips to, from, or within the city, according to the city’s transportation plan. Coupled with almost 10,000 vehicles registered per square mile, San Francisco today has one of the densest concentrations of cars on the planet, more than any peer city in the United States. In the business-as-usual scenario, the streets are forecast to absorb another half-million car trips. By 2040 there will be 2.2 million car trips on the exact same street grid we have today.

This is madness and it is dysfunctional for everyone. If you think Muni is unreliable now, it will be useless in 2040 as it stalls in the morass of 2.2 million car trips jammed onto city streets. Pedestrian injuries and deaths will rise with another 160 cars hitting pedestrians annually, simply due to oversaturation of automobiles. Cyclists might be able to weave around the stalled traffic, but it will be an ugly scene that fouls the air. Motorists will be stuck in their own gridlock, evermore impatient, distracted, honking, lurching through blocked intersections, sneaking through yellow lights, blocking crosswalks, double parking, and irritated with fellow drivers and everyone around. No one will be happy

This does not have to be. The city’s transportation agency hopes to reduce car trips from 1.7 to 1.6 million by 2018, a modest goal but barely holding the line. Reducing existing car trips by 100,000 while also adding thousands upon thousands of housing units and jobs, most coming with more parking, will quickly undo this humble ambition. The city can do more and the data shows us that there are many opportunities.

Consider that 68 percent of car trips within San Francisco are less than three miles. That’s 650,000 car trips per day that are generally pretty short — with a bicycle it’s less than a half-hour ride on relatively even terrain. If the city were able to get half of those car trips to switch to bicycle trips, it would be well on its way to averting carmageddon.

A more ambitious goal, increasing cycling to 20 percent of all trips, is the official city policy adopted by the Board of Supervisors. That’s 500,000-600,000 trips by bicycle every day, most of which can take place within that three-mile range, especially if cleverly arranged “wiggles” (level routes circumventing steeper hills) are laid out on the most logical corridors. But to carry that many cyclists, real space has to be allocated for them.

Out at San Francisco State University, where I teach a new Bicycle Geographies course that aims to increase cycling to the campus, there is tremendous opportunity to shift these kinds of short trips to bicycling. For students, faculty, and staff, bicycling is compatible with rapid transit, particularly for the “last mile” segments, such as between BART and SF State.

Bicycling is also a way to relieve local bus and light rail transit crowding — the 28 bus line on 19th Avenue, for example, is often jam packed and the city has only modest goals to improve that key line. Unlike transit or highways, bicycles do not require costly, long-term capital investment or operating funds and so can be deployed much more quickly.

It will be decades and cost hundreds of millions to improve the M-line, only now in the planning phase. We can lay down cycletracks much more quickly. Bicycling is also among the most equitable forms of urban transportation because it is affordable and accessible to almost everyone. This is obviously relevant to working-class students at SF State.

SF State has a memorandum of understanding with the city that obliges the university to reduce drive-alone automobile trips to campus, and the campus will not build any more car parking. With 4 percent of commute trips to SF State by bicycle (and only 2 percent among faculty) there is potential to increase the mode-share of bicycling as a path to reducing greenhouse gas emissions and auto trips.

The spatial proximity to Daly City and Balboa Park BART stations, as well as the Excelsior and Sunset, all under three miles from campus, means that the bicycle is well-suited to be a substitute for many short-range automobile trips and help the campus meet its goals. Yet what my students have found this semester is that it is all but impossible to bike safely to and from SF State, and the southwestern quadrant of San Francisco is largely left out of current bicycle planning in the city.

Taking multiple bicycle field trips over the past few months, we surveyed the opportunities for making safe routes to campus and envisioned what it would take to increase cycling to 20 percent of trips to and from SF State. Starting with the Balboa Park station, which is next to a deplorable tangle of freeway ramps, we ask what it would look like if fully-separated cycletracks were built on Geneva or Ocean avenues. These could connect City College and the Excelsior, and by way of a westward and southward jog, to a bicycle boulevard on Holloway Avenue, enabling a safe and convenient, 1.7-mile, 15-minute bike ride to SF State. Expanding the nascent Bay Area Bike Share to connect SF State and Balboa Park BART would create even more opportunity for cycling.

To the south of SF State, Daly City BART is a 1.4-mile, 10-minute bike ride that is daunting and poorly signed. It could be made safe and inviting with bicycle boulevards on streets parallel to traffic-clogged 19th Avenue and Junipero Serra. Borrowing from signature bicycle and pedestrian bridges in Pleasant Hill and Berkeley, perhaps there is an opportunity to build a bridge across Brotherhood Way toward the BART station, leveling an otherwise steep climb that discourages cycling.

To the north of campus, describing the designated 20th Avenue bicycle route as “a bit of a challenge” is an understatement. Cyclists must thread a cluttered shopping mall parking lot and overbuilt wide streets, and then confront a median blockading the way across Sloat Boulevard. While the megaproject to improve the M-line could include a cycletrack on this stretch of 19th Avenue, we should not wait a generation to increase cycling between SF State and the Sunset. The 20th Avenue route can be made welcoming now, with a fully-separated cycletrack and fixes on the Sloat intersection.

SF State, probably one of the most diverse campuses in the nation, has highly motivated students seeking real solutions to the huge problems society faces. The students are coming of age under extreme pressure of economic inequity and ecological duress, but they also see ways out of the mess created by the wasteful car culture and its linkages to ecological and social problems. They want to act now, and unlike past generations, they are shunning driving and many of them desire to reside in livable cities that offer choices for how they get around.

But what we have found this semester is that the campus is extremely isolated, difficult to access by bicycle, and walled-off by car sewers. Older, uninviting bicycle lanes are fragmented, disjointed, and seem to be an afterthought. With imagination, ingenuity, and political will, this can be remedied with bicycle improvements that cost far less than adding more car lanes and parking to the campus or surrounding area. And this would go much further at improving quality of life for neighbors who now have to put up with campus-generated traffic. Keeping the status quo, which means even more car trips but within the same space, is a dead end.

 

TRANSBAY DREAMS

Speaking of dead ends, San Francisco seems to specialize in dead-end train projects. The Central Subway, which is experiencing cost overruns and possible mismanagement, is one of these dead ends. There is no current option to have trains exiting to Geary or onto Columbus and possibly running on Lombard into the Marina, and that is a shame. Having the subway exit to the surface is probably the only way to make this project worthwhile.

There’s another dead end train project at the Transbay Terminal in downtown San Francisco. Yet unlike the Central Subway quagmire, I am impressed with the scale and possibilities for the Transbay Terminal project and there is opportunity to fix this dead end. Going back to the city’s business-as-usual traffic forecast, in 2040 car trips into the city from the Bay Bridge would increase 18 percent, and by 21 percent from San Mateo County. Aside from scratching my head wondering where exactly all of these cars are supposed to go, we simply need to stop this onslaught before the city becomes too dumb to move.

BART cannot solve it alone, as it will probably approach half a million riders per day by 2016, placing many downtown stations at or near capacity. BART also does not run all the way down the peninsula. Sometimes there are back-of-the envelope proposals to build a second BART tunnel under the bay, but this idea should be weighed against another idea. Rather than build a second BART tunnel to Oakland, how about a joint Amtrak California/Caltrain tunnel under the bay, and creating a true Grand Central Station of the West at Transbay? Let’s punch through the dead end currently planned for the east end of the Transbay Terminal “train box” and truly connect Northern California by rail.

This does not need to be high-speed rail, but rather the conventional, off-the-shelf electric rail already planned for Caltrain, of the variety that operates in the Northeastern US and much of Europe — efficient, high capacity trains that can travel 100-120 mile per hour comfortably and safely. In conjunction with a new transbay rail tunnel, the Capitol Corridor should be electrified and right of way captured from the freight railroads. One could take an electrified “baby bullet” from San Jose, through San Francisco, and continue to the East Bay and Sacramento. As Caltrain is electrified to the south, let’s also electrify the Altamonte Commuter Express trains, bring them across a rebuilt Dumbarton Bridge, and run high-frequency rail service into the new Transbay Terminal.

Understanding that this will take time to build, in the short term the Bay Bridge should be reconfigured to have bus-only lanes (and a bicycle lane on the bottom deck of the west span) and a greatly expanded AC Transit service that can relieve the looming BART crowding to the East Bay.

How to pay for these transbay dreams? A transbay rail project could get funding from Amtrak and other federal sources, requiring our congressional delegation to work for it. The state gasoline tax or eventual carbon taxes, and revenue from tolling Bay Area freeways, should be in the mix. The 101 and 280 should be tolled as well as the Caldecott Tunnel and I-80 in the East Bay, with revenue directed at electric rail in the long term and regional buses short term. And while people are talking about reforming Proposition 13 to end the artificially low property taxes on commercial land, let’s remember that transit — whether Muni, BART, or Caltrain — brings massive value to commercial property owners. They should be realistically expecting to pay in. In short, there are possibilities and ways to do this.

Here’s one small additional idea for raising seed money: In the wake of the Google bus controversy, the SFCTA, SFMTA, SF Planning Department, and City Attorney’s Office should assemble a crack team of California Environmental Quality Act experts and send them (on Caltrain and bike share!) down to comment on every large-scale suburban office project proposed in Silicon Valley. For example, Mountain View, where Google has its campus, is effectively displacing part of its transportation and housing responsibility to San Francisco.

As part of the CEQA mitigation for these suburban office projects, San Francisco ought to be demanding that Google/ Mountain View contribute to paying for the Transbay Terminal and electrifying Caltrain (a separate fund would be directed to affordable housing as mitigation for displacement). This is a similar line of reasoning to the May 1 lawsuit against the Google bus pilot, but it draws in those responsible for the poor planning in suburban sprawl. Regardless, the city ought to take a look at a CEQA mitigation angle for addressing the impacts these suburban decisions are having on the city.

 

PRAYING FOR ENLIGHTENMENT

One last point about transit finance: I sure hope Mayor Ed Lee, his political advisors, and all those religious ministers who complained about paying for metered parking on Sundays (see “Politics over policy,” April 22) have a plan to advocate for the November ballot proposals to help finance Muni.

They sold out sustainable transit advocates, their biggest ally on the November ballot initiatives, and have offered no rational explanation for their strategy, just an emotional hunch that somehow some people can’t cope with Sunday metering, and that making it free again will convince them to support increased public transit funding.

I imagine there is a well-thought-out campaign strategy, whereby every Sunday between now and November, the mayor is visiting all the churches in the city, and cajoling the ministers to use their pulpits to enthusiastically preach the merits of increasing the vehicle license fee (as well as approving a related general obligation bond).

After all, the VLF is a progressive tax — the more expensive your car, the more you pay. The older and cheaper your car, the less you pay. And bringing in $73 million annually would contribute to making God’s green earth cleaner, and help transport God’s children safely to work and on their errands. Praise the Lord and free parking on Sunday! Amen.

Two views of the waterfront

The Golden State Warriors’ announcement that its planned 18,000-seat basketball arena would be moved off the San Francisco waterfront was fresh in everyone’s mind when former San Francisco Mayor Art Agnos visited the Bay Guardian office on April 23, and he was electrified by the win.

“I resent anyone suggesting that this is not a genuine people-powered victory — again,” Agnos said. “Because that’s what it was, bottom line.”

The former mayor has traveled up and down the city in recent months promoting Proposition B, an initiative on the June 3 ballot that may well have cleared the Warriors Arena from its proposed waterfront perch at Piers 30-32 had the team not announced that it would be taking that step independently.

If it passes, Prop. B will require voter approval for any development project along city-owned waterfront property that exceeds height limits set by the Waterfront Land Use Plan approved in 1997. Such a rule would have squarely targeted the Warriors’ proposal.

The sports arena had been slated for a 13-acre parcel a stone’s throw from the Bay Bridge that is now a parking lot, where it would have hovered above the water like a floating spacecraft. Across the street, at a site known as Seawall Lot 330, the Warriors had proposed installing shops, parking, a condo tower, and a hotel.

Agnos and the backers of Prop. B hadn’t anticipated the Warriors’ announcement that its waterfront venue would be moved to private property, a 12-acre lot in Mission Bay purchased from tech giant Salesforce.com.

“We thought, because people at the top of this city’s government told us so, they would prevail,” Agnos said of Mayor Ed Lee and others championing the waterfront arena. “They didn’t.”

Agnos and his allies say it was the prospect of voters having to sign off on a proposal that was hatched behind closed doors that caused the Warriors to choose a more appropriate location.

“We helped them go to a different place where we now support what they’re doing — because it makes more sense for this city, and for our bay, as well as our waterfront. That’s what the issue is,” Agnos told us. “The spin doctors had their ass handed to ’em … had their ass handed to ’em, by a low-income group of allies, over their $20,000–$30,000, gold-plated contracts per month. And so now, they understand.”

They understand that the waterfront of San Francisco is a battleground and the people are willing to fight to ensure the public interest trumps private profits.

PRECIOUS PARCELS

The existing waterfront juts out considerably from where its natural edge once fell, and today’s urban landscape features a mix of entire neighborhoods, tall buildings, parks, restaurants, merchant corridors, and transport terminals, all perched atop fill covered by layers of concrete.

Its shipping days long gone, much of San Francisco’s human-constructed waterfront now serves as a draw for visitors, the iconic subject of countless tourist photographs. But at other locations along the shoreline, vacant waterfront parcels are hotly contested land-use battlefronts.

“We’re clearly in a period of significant controversy,” the Port’s Special Project Manager Brad Benson told us. The Warriors Arena, Benson said, had been an opportunity for the Port to rehabilitate and generate revenue from Piers 30-32, which originated as two finger piers constructed in 1912, joined by a concrete slab in the 1950s.

Despite being in control of some of the most valuable real estate along the West Coast, the Port of San Francisco remains in a perpetual financial pinch, due to its need to fix up crumbling piers and aging infrastructure. The Port is governed by a Waterfront Land Use Plan, outlining possible uses for each parcel, and it also conducted a survey to identify properties that could be developed to help generate revenue.

“The Port has a big capital need,” Benson said, noting that many of the “piers and buildings were beyond their useful life when they were transferred to the city” from the state in 1968. Facing nearly $2 billion in capital needs, the Port’s modus operandi is to seek out private developers to partner with on development projects for parcels under its ownership, in order to secure funding that would go toward backlogged improvements.

That didn’t happen with the Warriors, however — the sports team approached the city out of the blue, and the project quickly won the fervent backing of Mayor Lee, who has appointment power over the five-member commission that governs the Port. At one point, Lee even claimed that this flashy sports arena would be his “legacy project.”

To longtime grassroots activists who are deeply involved in how land-use decisions are made on valuable waterfront parcels, it looked to be yet another example of what Prop. B supporter Jennifer Clary called “kneejerk development” — out of sync with carefully thought out shoreline planning efforts.

“The Port gets jerked around by every mayor,” said Clary, president of San Francisco Tomorrow, part of the coalition backing Prop. B. “Every mayor comes up with some stupid project.” She ticked off a list of failed waterfront developments (such as Mills Mall, proposed for Piers 27-31; and a 50-story U.S. Steel Building that would have towered over the Ferry Building), only to have them voted down or halted by grassroots neighborhood activists who viewed them as inappropriate designs fueled by greed and greased by political connections.

Behind the objection to Prop. B, Clary added, “is that the mayor will have to think a little more” before backing projects of this nature.

Whether opponents of the Warriors Arena plan looked at it and saw a traffic nightmare, an inappropriate use of public land, or a bad financial deal for a city needing to contend with ever-growing pressures on its critical infrastructure, members of the coalition that’s backing Prop. B feared the public would have little sway when it came to the final decision-making. A bid to restore that balance, by arming voters with veto power under the law, was the impetus behind Prop. B.

City Hall has ignored the will of regular folks who collectively own Port land along the shoreline, said Agnos, campaign consultant Jon Golinger, and Prop. B proponent and Sierra Club volunteer Becky Evans — listening only to the Mayor’s Office and deep-pocketed developers who stand to make millions by building on extremely valuable land that’s held in the public trust under California law.

“The people are putting the developers in touch with the values of this city, and what we want in this city,” Agnos said, thumping his index finger on the table to emphasize the point. “Prop. B puts people in the room who have not been there, and now [developers] have to pay attention.”

The task of developing Piers 30-32 would have required expensive substructure modification, requiring the involvement of bureaucratic agencies such as the US Army Corps of Engineers, the Bay Conservation Development Commission, and the State Lands Commission. The Warriors estimated that it would invest $120 million in improvements such as seismic upgrades and an elevation grade to deal with the looming problem of sea-level rise, but the threat of having to win voter approval represented yet another hoop to jump through. So when a new option opened up offering greater certainty, the Warriors pulled the plug on Piers 30-32.

Even though Lee’s “legacy project,” the main physical target of Prop. B, is no longer a factor in the June election, backers of the initiative say the measure is still important to restore democratic balance in a development process that freezes out ordinary citizens. Opponents, meanwhile, say the initiative threatens to undermine a complex planning process that engages the public and needn’t be tampered with.

 

IN THE PIPELINE

Prop. B would prohibit city officials from approving taller buildings than are currently allowed under zoning for Port-owned waterfront parcels, unless voters give those height increases a green light at the ballot box.

Since many of the properties in question are already built out, or preserved by historic landmark designation, Prop. B would impact only a handful of waterfront lots that remain in play as potential sites for new development. Among them are Piers 30-32 and Seawall Lot 351, the site of the 8 Washington luxury condo tower that the electorate flushed down the tubes in a decisive ballot referendum vote last fall, despite Board of Supervisors’ approval.

The same group that opposed 8 Washington launched Prop. B. Last year’s ballot referendum — also named Prop. B, and buoyed by the campaign slogan No Wall on the Waterfront — asked voters whether they favored increasing building heights above the zoning limit at the waterfront site where the luxury condo project would have gone.

San Francisco voters, in no mood to support a high rise for the superrich at a time when anger over skyrocketing rents was bubbling over and droves of low-income residents were being edged out by eviction, shot it down. Many political observers took the outcome as a signal that City Hall politicians are out of touch with voters.

Simon Snellgrove, the developer of the failed 8 Washington project, is reportedly working on a new building design. But since any new plans for 8 Washington are embryonic at best, and the fate of Piers 30-32 is anyone’s guess, the Prop. B ballot measure has immediate implications for two waterfront developments in particular.

One, on and around Pier 48, is being pushed by the San Francisco Giants. The other lies farther south, at Pier 70, a sprawling strip of waterfront that runs behind Illinois Street, from The Ramp restaurant at Mariposa to the old Potrero Power Plant.

The Giants’ planned development would be a short distance from AT&T Park. 

During World War II, some 18,500 workers built ships at Pier 70 for the war effort, in brick and metal warehouses that still stand vacant and dilapidated. The site also housed a coal-fired power plant that was later converted to natural gas, leaving behind toxic residue that is up to Pacific Gas and Electric Co. to remediate. Farther north along Pier 70, BAE Systems conducts ship repair, a task that has been performed at the site since 1868.

Today, a 28-acre parcel of Pier 70 that is proposed for development by Forest City is home to nothing more than pigeons, feral cats, and the occasional hawk that swoops into a cavernous metal-roofed structure that stands near the waterfront and dates back to 1941, barely visible from the street. Someday in the not-so-distant future, developers imagine it will be populated with tech office workers (Google is used as an example of an anchor tenant in slides presented to the city), makers and small vendors, and thousands of residents who would call the place home.

The site is zoned with a 40-foot height limit, but developers are considering plans with a range of building heights that would be on a similar scale to Mission Bay. Part of the improvements to the property will require raising the elevation grade to deal with sea-level rise. Forest City has planned for a minimum of around 1,000 residential units — the majority market-rate, but with a mix of affordable housing as well.

Representatives from Forest City said that if Prop. B passes, “We’ll be prepared to seek voter approval with a dynamic project guided by … a community-based master plan,” and had not taken an official stance on the ballot measure. If voters were to reject an increase of the 40-foot height limit at the site, which is zoned for heavy industry, the project would no longer be financially feasible.

 

GIANT TOWER SCRUTINIZED

At Seawall Lot 337, a parcel near the Giants’ stadium which is primarily used as a parking lot during baseball games, the team is backing a project that would include 3.5 million square feet of new residential, office, and retail development, possibly including a 380-foot tower. Across the way at Pier 48 would be a new Anchor Steam brewery, and about five acres of open space.

The Giants plan resulted from the Port’s request for potential development partners to submit bids for that property, which went out in 2007.

“They very quietly have been pushing a plan that Prop. B made public,” Golinger said of the Giants’ plans. “They screamed at everyone involved in our coalition during the signature drive to get us to drop it. They funded a lawsuit … to get it kicked off the ballot.”

The Guardian independently confirmed that the team is part of the group that has challenged Prop. B in court. That legal challenge was unsuccessful in getting the initiative struck from the June ballot, but a judge could take up the question again if Prop. B is approved.

The parcel where the Giants have pitched a rental housing, office, and retail complex with a maximum height limit of 380 feet is zoned with a height limit of zero, zoned for open space in city plans. Nevertheless, “The [Port’s request for qualifications] called for developing up to 300 feet,” Benson explained, calling the current zoning “a remnant of the old Mission Bay plan,” which envisioned a park with wetlands and open space. The Port’s request for proposals went out after a subcommittee was formed, and public hearings were held on the design plans.

Asked why the Port would bake such a tall height limit into its RFQ, Benson responded, “There was a desire to avoid replicating the heights at Mission Bay,” the nearby redevelopment area characterized by lower, boxy buildings that seem to be universally regarded as ugly and lacking charm.

Few people are as intimately familiar with Mission Bay as Corinne Woods, whose houseboat is enveloped on either side by the sprawling development. When Woods first claimed a berth at Mission Creek for her floating home in 1985, “it was surrounded by open empty fields, abandoned warehouses, and lots of fennel,” she said. “We had wonderful parties.”

Outside her dock just off Channel Street is a community garden, a strip of green space shaded by willow and eucalyptus trees where night herons take refuge. Just beyond that is the Mission Bay South redevelopment area, a sprawling construction site that’s ushered in building cranes, swirling dust, pile drivers, and more recently, a five-alarm blaze that required the entire Fire Department to extinguish.

The fledgling neighborhood that now occupies the already-built part of Mission Bay might as well have dropped out of the sky, and the building profiles are wide and flat. “I would rather see slim, articulated towers, with more open space,” Woods admitted.

In the years between 1985 and today, Woods has fought the Port on behalf of her live-aboard community to be allowed to remain floating in place, becoming an unlikely expert on the byzantine process of waterfront planning along the way.

As a key member of half-dozen or so community advisory groups formed to weigh in on major waterfront developments, Woods has ardent faith in the civic engagement aspect of the planning process. She fears Prop. B could upset years of careful neighborhood negotiations by limiting the discussion to nothing more than a conversation about height limits.

Woods is a plaintiff in the lawsuit the Giants are funding to challenge Prop. B, aligned with developer-friendly housing activist Tim Colen and building trades head Michael Theriault on the side that opposes Prop. B. But despite the millions of dollars that are on the line, Woods insists she has no dog in this fight. “I can’t even get free tickets to Giants games,” she said.

She does hope for the five-acre park that the Giants plan would install as part of the Seawall 337 / Pier 48 plan, a short walk from her houseboat. But she says her opposition to Prop. B is rooted in her experience of a traditional planning process that rewards neighbors who have the patience to sit through hours of grueling advisory group meetings with negotiating power vis-à-vis developers. Asked directly what the problem is with letting voters weigh in, Woods responded, “Because they don’t know what the fuck they’re talking about!”

But that leave-it-to-the-experts attitude is just the thing that Prop. B’s backers say is dangerous for waterfront planning, since it places final decision-making in the hands of profit-seeking real estate interests, a public agency in dire need of funding, and a mayor with political ties to developers.

 

THE HOUSING QUESTION

Given that the thrust of Prop. B is to democratize the planning process, few are in a hurry to align themselves with the formal No on B campaign — most of the opposition money seems to have been funneled into the Giants’ lawsuit, even though the Giants have officially taken a neutral stance on Prop. B. However, the message from opponents of Prop. B is that the initiative would kill sorely needed housing.

The Port of San Francisco, which is legally barred from taking a position on the initiative, reported in a February analysis to the Department of Elections that it could have the effect of leaving between 1,990 and 3,690 new housing units “delayed, reduced, or abandoned,” including between 268 and 596 affordable units. Those figures are based on early project proposals brought by the Warriors, the Giants, and Forest City, assuming those planning proposals would be “delayed by a need for a vote, or rejected by the voters” under a Prop. B regime.

A nonbinding Giants term sheet notes that the team would build rental housing, 15-20 percent of those units affordable, while Forest City’s Pier 70 proposal includes 1,000 new housing units with on-site affordable that would exceed the 12 percent required under city law.

Targeting housing “is a scary message,” campaign consultant Golinger said, charging the opposition with preying on voters’ fears to encourage people to vote down a measure that would democratize waterfront planning.

“This myth that we’re trying to stop housing is just that,” Agnos chimed in. “It’s just a political ploy by those who want to build high-end, high-rise, luxury condos — a la 8 Washington, a la Giants — on public property.”

The housing question is key. At a time when so many people are facing eviction or being priced out, the refrain that building more housing is the only solution to relieve pressure is oft-repeated, particularly by developers. However, these projects would introduce far more market-rate units than affordable projects, plopping down well-to-do neighborhoods in spaces that have sat on the margins in recent history, further changing the social character of the city. And proponents of Prop. B question whether the waterfront is really the right place to add new affordable units.

Meanwhile, the affordable housing community seems to be aligned in its support of Prop. B. The San Francisco Tenants Union, the Affordable Housing Alliance, the AIDS Housing Alliance of San Francisco, and other organizations that have aligned to push for stronger tenants’ rights and promote affordable housing have all endorsed the measure.

WHO DECIDES?

Given the popularity of a measure that fundamentally seeks to democratize the planning process, all development teams with skin in the game have declined to take a position on the measure. So have Mayor Lee and Board of Supervisors President David Chiu, who each played significant roles in recent waterfront battles, with Lee championing the Warriors Arena and Chiu opposing 8 Washington and assisting with the signature-gathering effort to stop it.

Sup. David Campos, in contrast with Chiu and Lee, has taken a stance on Prop. B. In a recent interview, he outlined his reasons for supporting it.

“I think that something has happened in City Hall, where I think the approval process is such that it has led to certain projects being approved that don’t really reflect the reality of what this city needs, and that have truly left the public out of the process in a meaningful way,” Campos told us. “And 8 Washington passed 8-3 at the Board of Supervisors, with a supermajority. The fact that the voters overwhelmingly rejected that project tells you that there has been a disconnect between what the board and folks in City Hall are doing, and where the public actually is.” To correct that imbalance and allow more San Franciscans to shape the city’s waterfront, Campos said, “I think it’s appropriate for us to go to the ballot and let the voters decide.”

SFIFF “I’m the wrong kind of person to be really big and famous,” Elliott Smith admits in Heaven Adores You, Nickolas Rossi’s moving portrait of the late indie musician, who went from regional star to superstar after his Oscar nomination for 1997’s Good Will Hunting. “It was fun … for a day,” Smith reflects — and anyone who saw Smith’s hushed Academy Awards performance, on a night that also included Celine Dion’s chest-thumping rendition of “My Heart Will Go On,” has likely never forgotten it.

But Heaven isn’t overly concerned with Smith’s sudden celebrity and mysterious end (in 2003, he was found with two apparently self-inflicted stab wounds to the chest, but his death was ruled “undetermined,” rather than a suicide). Instead, it’s an artfully crafted study of a unique talent, avoiding music doc clichés in favor of more creative choices, like illustrating college-radio interviews — far more revealing than anything Smith would share with journos seeking Oscar sound bites — with gorgeously composed shots of Smith’s beloved Portland, Ore. Heaven widens to contextualize Smith’s importance within the 1990s Portland scene, with former members of his pre-solo band, Heatmiser, and fellow musician and longtime girlfriend Joanna Bolme among the interviewees. (Unfortunately absent: Hunting director Gus Van Sant.) But Smith’s soulful, eerily timeless songs (described here as “little pictures made of words”) remain Heaven‘s focus — appropriate, since they were always Smith’s focus, too.

A less-tragic tale of reluctant fame unfolds in Jody Shapiro’s Burt’s Buzz, which opens as its subject, Burt’s Bees co-founder Burt Shavitz, arrives in Taiwan to what can only be described as a hero’s welcome. Given the fact that Burt’s Bees products crowd drugstore shelves as ubiquitously as Neutrogena and Cover Girl, you’d be forgiven for assuming THE Burt lives the lavish life of a lip-balm magnate. Which is not the case, since the aging Shavitz prefers an exceedingly spartan life in rural Maine, with a woodstove providing heat and a begrudging acceptance of running water. “A good day is when no one shows up, and you don’t have to go anywhere,” Shavitz opines.

Not that he has any choice. When Burt’s Bees went from homespun to corporate, all the dough went to Shavitz’s former business (and romantic) partner Roxanne Quimby, who’d bought him out when their relationship went sour; most of Shavitz’s income seems to stem from making personal appearances for a company he no longer has much else to do with. (Quimby’s upbeat son is interviewed in her stead, though we do glimpse her in excerpts from a TV program entitled How I Made My Millions.) Still, Shavitz — knowing that Burt’s Bees is stuck with him forever, since his name and bearded visage decorate the brand’s folksy packaging — remains remarkably blasé about his financial situation. He’s not into material possessions, though he’s comfortable enough to have a “majordomo” help him with his affairs, and is enough of a diva to demand rice milk rather than the soy milk proffered by his eager-to-please Taiwanese hosts.

Shapiro’s documentary is a bit overlong (do we really need to see ol’ Burt Skyping with his dog?), but it wisely highlights the most interesting element of Shavitz’s story, which is not “Did he get ripped off?” or “Look at this crazy hippie!” but “Is this guy more self-aware than he’s letting on?” Though his assistant insists “He’s like Colonel Sanders, and he simply does not understand that,” it’s never entirely clear — though Shavitz’s own assertion that “No one has ever accused me of being ambitious” certainly has the ring of truth, rather than bitterness, to it.

Elsewhere in SFIFF’s documentary programming, two films take contrasting approaches to the artistic process. Of local interest, Jeremy Ambers’ Impossible Light, a close-up look at the Bay Lights — the high-tech art installation that illuminates the western span of the Bay Bridge — smartly runs a lean 71 minutes. First, we meet project founder Ben Davis, who had a brain wave one sunny day while idly staring at the bridge, which he’d always appreciated despite its ugly-stepsister status next to the glamorous Golden Gate. After artist and LED wizard Leo Villareal joins up, the ball really gets rolling, and Light tags along as a dedicated group of big thinkers form alliances with Caltrans engineers and other hands-on types who believe in Davis’ “impossible idea.” Nobody who sees this film about what became a truly collaborative process — Bridge workers scale the towers, tinkering with laptops! Creative types scramble to raise eight million bucks from private donors! — will ever take the intricately twinkling end result for granted.

The opposite of straightforward: The Seventh Walk, inspired by the nature-themed art of Indian painter Paramjit Singh. Director Amit Dutta brings Singh’s work to life with his questing camera, floating through the Kangra Valley’s leafy forests and across streams as water rushes, birds squawk, and insects hiss on the soundtrack. We also see Singh himself, dabbing his textured, abstract work onto canvases as the movie around him becomes more surreal. Occasional poetry fragments appear on screen to make the waking-dream vibe even more immersive: “Deep in the forest, the musk deer frantically pursues its own fragrance: laughter!”

Despite its title, it takes awhile for laughter to enter Happiness, Thomas Balmès’ tale of Peyangki, a restless nine-year-old monk living in remote Bhutan — the last pocket of the country, which prizes its “gross national happiness,” to get electricity. Stunningly composed shots (those mountains!) showcase a simple, deeply traditional lifestyle that’s about to completely change, for better and probably worse — ominously, everyone’s conversations already revolve around television. A more conventionally-structured doc comes from Stanley Nelson, no stranger to powerful material with previous films like 2011’s Freedom Riders, 2006’s Jonestown: The Life and Death of People’s Temple, and 2003’s The Murder of Emmett Till. Nelson returns to the civil rights movement for Freedom Summer, which mixes archival material and contemporary interviews to detail the youth-propelled African American voter drive amid menacing intolerance in 1964 Mississippi.

News reports about the disappearances of workers James Chaney, Andrew Goodman, and Michael Schwerner — “Mickey” to wife Rita, as eloquent and composed today as she is in 1964 footage — weave throughout the film, with the discovery of their bodies recalled by folk legend Pete Seeger, who learned about it while performing on a Mississippi stage. While the events detailed in Freedom Summer have been covered by numerous other documentaries, Nelson’s impressive array of talking heads (not identified by name, though many are recognizable) brings a personal, eyewitness touch to this history lesson. *

VOICE FOR PRISONERS

Throughout his 29-year journalism career, Peter Sussman, a retired San Francisco Chronicle editor, advocated for greater media access to prisoners and fought to uphold the rights of inmate journalists. In the 1980s, federal prison officials cracked down on inmate Dannie “Red Hog” Martin for writing to Sussman to share what life was like behind bars.

The retaliation spurred an epic battle over free speech within prison walls, and Sussman responded by publishing Martin’s regular writings about prison life, and later co-authoring a book with him titled Committing Journalism: The Prison Writings of Red Hog.

In the mid-’90s, Sussman fought state prison officials’ restrictions on media interviews with prisoners. He also helped write and sponsor statewide legislation to overturn limits restricting media access to prisons. Sussman will receive the Norwin S. Yoffie Award for Career Achievement.

 

GUIDING ASPIRING JOURNALISTS

Beverly Kees Educator Award winner Rob Gunnison is a former instructor and administrator at UC Berkeley’s Graduate School of Journalism, where he arrived after spending 15 years covering government and politics in Sacramento for the San Francisco Chronicle.

As a longtime instructor of a course called “Reporting and Writing the News,” Gunnison has continued to educate hungry young journalists on how to seek public records and carry out investigative reporting projects.

 

EXPOSING ATROCITIES

Peter Buxton will be honored with the FOI Whistleblower/Source Award. In 1972, Buxton played a key role in alerting the press to the ongoing operation of the Tuskegee syphilis experiments, where African American sharecroppers were intentionally exposed to the disease, without treatment or their knowledge, so researchers could study its progression.

By the time the story was related to the press, 28 men had died of syphilis, and 100 others had died of related complications. That leak helped spur Congressional hearings on the practice beginning in 1973, ultimately spurring a complete overhaul of federal regulations. A class-action lawsuit was filed, resulting in a $10 million settlement.

 

EXPOSING BART’S SCHEME

Reporter Tom Vacar of KTVU pushed for records determining whether replacement drivers that BART was training to help break last year’s labor strike were qualified to safely operate the trains, eventually finding that they had been simply rubber-stamped by the California Public Utilities Commission.

Those findings proved gravely significant on Oct. 21 when two workers on the tracks were killed by a BART train operated at the time by an uncertified trainee, an accident still being investigated by the National Transportation Safety Board.

 

STANDING FOR SUNSHINE

California Sen. Leland Yee is once again being honored by SPJ Norcal for his work on sunshine issues, including last year criticizing Gov. Jerry Brown and other fellow Democrats who had sought to weaken the California Public Records Act, instead seeking to strengthen the ability of the courts to enforce the law.

 

FIGHTING THE CITY

Freelance journalist Richard Knee’s Distinguished Service Award caps a 12-year fight for open government in a city eager to stash its skeletons securely in closets.

Knee is a longtime member of the San Francisco’s Sunshine Ordinance Task Force, created in 1994 to safeguard the city’s Sunshine Ordinance, and he has fought to maintain its power and relevance.

Over the years, many city agencies have fought against the task force, from the City Attorney’s Office to a group of four supervisors who claimed the task force was wasting public money, a struggle that is still ongoing.

 

BADGES AND ACCOUNTABILITY

The Lake County News and its co-founders Elizabeth Larson and John Jensen will received a News Media Award for a protracted legal battle with local law enforcement for a simple journalistic right: interview access.

The scrappy local paper detailed allegations that Lake County Sheriff Frank Rivero and his deputies wrongfully detained suspects on trumped up charges, made threats, conducted warrantless home searches, and violated suspects’ civil rights.

Rivero’s office responded by blacklisting the paper from interviews, a fundamental building block of news coverage. The paper sued the Lake County Sheriff’s Department, eventually winning its battle to obtain the right to keep asking the sheriff the tough questions.

 

PROTECTING THEIR SOURCES

When Saratoga High School student Audrie Potts committed suicide in September 2012, her parents alleged she was pushed over the edge by cyber bullying over photos of Potts at a party. High school journalists Samuel Liu, Sabrina Chen, and Cristina Curcelli of The Saratoga Falcon scooped the sensational national media outlets that descended on the story, but they were subpoenaed by the Potts family to reveal their sources.

They refused, citing California’s shield law in a successful legal defense that strengthened the rights of student journalists. As Liu said, “We are not willing to destroy our journalistic integrity by giving up our confidential sources, we got this information on the condition of anonymity, from people that trusted us.”

 

BUYING FRIENDS AT CITY HALL

Bay Guardian News Editor Rebecca Bowe and Reporter Joe Fitzgerald Rodriguez are being honored with a Journalist Award for “Friends in the Shadows,” (10/8/13) our investigation of the shady ways that developers and other powerful players buy influence at City Hall.

“Their detailed and thorough account explored a trail of money through myriad city agencies and departments,” the awards committee wrote, noting how the paper “used public records, interviews and independent research to probe how developers, corporations and city contractors use indirect gifts to city agencies to buy influence.”

 

NEWS FROM INSIDE

For accomplishing “extraordinary journalism under extraordinary circumstances,” The San Quentin News is being honored with a News Media Award. It is California’s only inmate-produced newspaper, and one of the few in existence worldwide.

The San Quentin News publishes about 20 pages monthly, and has a press run of 11,500 for inmates, correctional officers, staff, and community members. It’s distributed to 17 other prisons throughout California.

Under the scrutiny of prison authorities, the inmate journalists and volunteers wound up covering a historic prison hunger strike, the overcrowding of the prison population, and the denial of compassionate release for a dying inmate, an octogenarian with a terminal illness.

 

EXPOSING TORTURERS

The Western Hemisphere Institute for Security Cooperation (WHINSEC), better known as the name it held prior to 2001, the School of the Americas, is a combat training school for Latin American soldiers and commanders, with many graduates going on to commit human rights atrocities.

School of the Americas Watch founder Judith Litesky, a former nun, and Theresa Cameranesi, filed a lawsuit in federal court in San Francisco seeking the list of those who had gone though courses that include counter insurgency techniques, sniper training, psychological warfare, military intelligence and interrogation tactics.

Last year, the pair won a significant victory when a federal judge in Oakland ruled that the government could not cite national security reasons in withholding the names. Although the case is ongoing, they are being honored with a Citizen Award.

 

FIGHTING CORPORATE SNOOPS

In 2008, journalists from The New York Times and BusinessWeek looked to Terry Gross of Gross Belsky Alonso for legal counsel in a case against Hewlett-Packard. In a staggering display of corporate snooping, the tech giant had illegally obtained private telephone records of the journalists, in an attempt to gain access to the identities of their sources.

Gross has also defended journalists against police in cases regarding media access for breaking-news events, and he’s helped to expand the rights of online journalists. This year, Gross will receive the FOI Legal Counsel Award.

 

BAD BRIDGE, GOOD JOURNALIST

Sacramento Bee Senior Investigative Reporter Charles Piller will be honored with a Journalist Award for exposing corrosion problems in the long delayed, cost-plagued eastern span of the San Francisco-Oakland Bay Bridge. His breaking story and subsequent follow-ups revealed Caltrans’ inadequate corrosion testing, as well as inadequate responses to bridge inspectors who for more than two years warned Caltrans of water leaks and corrosion — only to go unheeded.

 

SUNSHINE COLUMNIST

Editorial and Commentary Award winner Daniel Borenstein, who writes for the Bay Area News Group, issued a strong response to a legislative attack on California’s Public Records Act last year, ultimately helping to defeat proposed changes that would have gutted the law.

“Without the state Public Records Act, we would never know about the Oakley City Manager’s $366,500 taxpayer-funded mortgage scheme, the Washington Township hospital CEO’s $800,000-plus annual compensation or the retired San Ramon Valley fire chief’s $310,000 yearly pension,” Borenstein wrote in one of his columns. “We would be ignorant of broken bolts on the Bay Bridge, the cover-up of Moraga teachers sexually abusing students, a BART train operator who collected salary and benefits totaling $193,407, the former BART general manager who received $420,000 the year after she was fired or the Port of Oakland executives who spent $4,500 one night at a Texas strip club.”

When The Landscape Is Quiet Again: North Dakota’s Oil Boom

In a land far, far away, the greedy hands of oilmongers are ripping apart Sarah Christianson’s home state. “Almost every local person I spoke with out there expressed some version of this sentiment: ‘I’m so glad so-and-so is dead, so they don’t have to see what’s happened to this place,'” says the photographer. Over the past year, Christianson documented the consequences of North Dakota’s newest oil boom: oil wells built on her parent’s mineral acres, drilling rigs planted on desolate horizons, natural gas flare pits disrupting untouched valleys. Her latest project, “When the Landscape is Quiet Again” hosted by SF Camerawork through April 19, examines the lasting repercussions of North Dakota’s 1973 oil boom, the new damages being inflicted today and the dichotomous effects on this economically depressed region. Many modern Americans might have struggled with breakfast in the mid-1800’s, according to author Heather Arndt Anderson: “Bacon and eggs, pancake with syrup, and hot coffee were now considered as ‘injurious’ to one’s health as masturbation.” Anderson explains in her book Breakfast: A History how Americans’ healthy living attitudes at that time spurred the development of granola as a popular food. Anderson’s origin stories and accessible anthropological analysis showcase how the early day cuisine from different eras shape what we eat today. “Breakfast” also explores how culture, linguistics, religion and mass media elevated the morning meal’s status to the most important meal of the day. The lead single “If I Gave You My Love” showcases the duo’s one-two punch of Barry White-esque vocals on the chorus, surrounded by peppy falsetto. After slow simmering yet heavy hitting releases like ‘Sunshine,’ John Talabot released his debut ƒIN in 2012 to crossover attention. “Committed Cinema: Tony Buba” Braddock, Penn., got its big-screen moment last year with the release of Out of the Furnace, Scott Cooper’s occasionally overwrought tale of two brothers battling grim destinies in the crumbling steel town. As it turns out, documentarian Tony Buba has been lensing his blue-collar hometown for decades, and the filmmaker dubbed “a national treasure” by the Anthology Film Archives is coming to Berkeley to share his work and converse with USF education professor Rick Ayers. Tonight, “The Braddock Chronicles” compiles shorts from 1972-85. More shorts precede screenings of narrative Lightning Over Braddock: A Rustbowl Fantasy (1988), and his most recent doc, 2013’s We Are Alive! OPINION How would you like to increase your spending power by 10 times (or more), relieve student debt by more than 90 percent, increase Social Security benefits, lower taxes, increase pay for teachers, and lower loan amounts for homes and small business to 1-2 percent?

I’ll bet I have your attention. I’m sure you think this is crazy talk, but this is based on a movement that is already happening. It’s the public banking movement.

In 1950s, the buying power of the dollar was over 10 times what it is today. That means you were able to buy 10 times the amount of goods and services with a dollar compared to what you can now.

What happened? Why is it so hard for most people to just barely get by these days? And why are so many are not getting by at all?

First, let’s review how money is created. Did you know the money we have in circulation today is created out of thin air? Most of it is just an entry in a computer system. A small percent is printed dollar bills like you have in your wallet or purse, and a very small percentage is metal coins.

Money is simply trusted as being worth what it says on the bill, coin, or computer screen. Did you also know that money for loans is created this way as well?

When you take out a loan from a bank (for a home loan, a student loan, a business loan, a car loan, etc.), the money that the bank loans you (with interest charges) is not taken from other people’s deposits. It is made (mostly) out of thin air. It is simply an entry in their computer system … that’s it.

Most people think they are borrowing money that is deposited into the bank by other people, but this is not true.

Here is quote from Robert Anderson, the secretary of the US Treasury in 1959, on this topic: “When a bank makes a loan, it simply adds to the borrower’s deposit account in the bank by the amount of the loan. The money is not taken from anyone else’s deposits: it was not previously paid in to the bank by anyone. It’s new money, created by the bank for the use of the borrower.”

Why is this a problem? Let’s look at how much interest we’re paying on a variety of loans. If you buy a house for $500,000 in 30 years at an average interest rate, you will pay an additional $580,000 in interest on money the bank made from thin air. With a public bank you, would pay less than half this amount.

On public projects like bridges, roads and schools, 30-50 percent of the cost is interest. The new span of the Bay Bridge that was just opened at a cost of $7 billion, the interest on this project is estimated to be an additional $7 billion. It’s estimated that the cost of almost everything you buy is increased by 35-40 percent because of interest.

This is just the tip of the iceberg.

The solution to the problem is a public bank. With public banks, these billions of dollars of profit (via interest) are recycled back into the public treasury instead of funneled off to private banks.

If you think this is some theoretical fantasy you should know that San Francisco is currently looking at creating a public bank, 20 states are also considering them, and North Dakota has had a public bank for over 90 years. This is not a new idea.

Nobody knew exactly when the bus would leave. It was the afternoon of Oct. 17, and a group of about 60 immigrant rights activists were gathered in the shade of some tall trees in a park by the TransAmerica Pyramid in downtown San Francisco.

Many were young, Latino or Asian Pacific Islander, dressed in hooded sweatshirts, baseball caps, and slim-fitting jeans. They chatted and milled about, perhaps trying to ease a gnawing sense of anticipation over what was about to happen.

Half a block away and out of view, federal Immigration and Customs Enforcement officers were leading passengers onto a white bus, parked at the ICE building at 630 Sansome St., with a “Homeland Security” label inscribed on the front. All the passengers were ICE detainees; some were about to embark on long deportation journeys, while others were being sent to detention centers where they would remain in limbo until either being deported or exonerated.

Back at the park, organizer Jen Low was peering at her phone every 10 minutes. “They’re locking the bus!” she exclaimed after reading a text sent by someone on the lookout. That meant it was almost time to go. The activists started organizing themselves into two groups: Those willing to risk arrest, and those planning to rally in support.

The ones facing arrest were planning to engage in peaceful civil disobedience, by placing their bodies in front of the bus to prevent it from going anywhere. “About half of the people who will be blocking the bus are undocumented,” Low told the Guardian as they prepared to exit the park. “That’s why some of us are so on edge right now.”

They headed toward the ICE building en masse, slowly at first and then quickening their pace, some hastily peeling off top layers to reveal handmade T-shirts underneath proclaiming, “Not one more.” Others were already stationed at the bus, and as 10 protesters linked arms and settled onto the street in front of it, someone had already started up a chorus of “We Shall Not Be Moved.”

 

INTO ICE CUSTODY

They’d been inspired by a recent ICE bus blockade carried out by Arizona activists, organizer Jon Rodney said, and the civil disobedience was meant to send a message to President Barack Obama that it’s unfair to continue deporting undocumented people as long as a resolution on federal immigration reform remains stalled in Congress. Rodney’s organization, the California Immigrant Policy Center, has emphasized family unity as a guiding principle that should inform immigration reform efforts.

A variety of organizations had been involved in planning the action, including the California Immigrant Policy Center, Causa Justa/Just Cause, POWER (People Organized to Win Employment Rights), ASPIRE (Asian Students Promoting Immigrant Rights through Education), and the Asian Law Caucus.

Among the protesters was Dean Santos, a 23-year-old originally from the Philippines who had been brought to the US when he was 12. Not so long ago, he’d been transported out of San Francisco on a white deportation bus leaving from that very building. Faced with a trumped-up felony that was later downgraded to a misdemeanor, Santos was taken into federal custody in late 2010 because the initial serious charge triggered ICE involvement.

He was given the choice of voluntary deportation or indefinite detention while he fought his case. Santos chose the latter. He called his mother in San Bruno, where they lived, and apologized for what had happened.

Locked in a cramped cell in the San Francisco ICE building, he started to feel overcome with fear, but an elder man he was detained with offered comforting words. “He told me he had also decided to stay and fight, and he said he was doing it for the sake of his daughters,” Santos recalled.

That’s when it hit him that he wasn’t the only one whose life was potentially about to be upended due to deportation. The realization eventually fueled his activism, he said. He was inspired to participate in the undocumented youth movement to call for just and inclusive immigration reform, and he’d joined the ICE blockade as a member of ASPIRE and the Asian Pacific Islanders Undocumented Youth Group.

 

TWO MILLION DEPORTATIONS

In just a short time, the scene outside the ICE building had become zoo-like. Television news crews appeared, police cars raced up with lights flashing, and a few young ICE guards, sporting thick black vests and belts with holstered weapons, stood by the bus in wide defensive stances.

More than 100 supporters formed a procession and encircled the vehicle, waving signs and chanting as they went round and round. “Down, down with deportation! Up, up with liberation!” Some chants were in Spanish: “Obama, escucha, estamos en la lucha!” (Obama, listen, we’re in the struggle.)

Obama delivered comments that very day, as the federal government was reopening after being shut down by Congress, signaling that immigration reform was the next major agenda item.

“We should finish the job of fixing our broken immigration system,” the president said in a televised address from the Rose Garden. “There’s already a broad coalition across America that’s behind this effort — from business leaders to faith leaders to law enforcement. The Senate has already passed a bill with strong bipartisan support. Now the House should, too. It can and should get done by the end of this year.”

California has the largest immigrant population of any other state, with an estimated 2.8 million undocumented Californians. Advocates are calling for the creation of a path to citizenship that isn’t overly burdensome, and for immigration policy that doesn’t rely on detention and deportation as cornerstones of immigration enforcement.

“We were really hoping immigration reform would pass and reduce deportations,” Asian Law Caucus staff attorney Anoop Prasad told the Bay Guardian just before the protest got underway. Instead, “Obama is closing in on his two millionth deportation since becoming president,” he said, a higher number than those carried out under President George H.W. Bush when he’d been in office for the same duration.

Much of that steep increase has to do with technological capability and information sharing under Secure Communities (S-Comm), which has resulted in an estimated 90,000 deportations of undocumented people in California alone.

Prasad said he had reviewed the roster of detainees loaded onto the bus earlier that day. They’d been taken into ICE custody in various Northern California cities, including San Francisco, and they had origins in Russia, Mexico, Ethiopia, Vietnam, El Salvador, India, and other countries. Some had children, and a few were minors themselves.

“One guy has been here since he was 11 months old,” Prasad said. “Now he’s in his 40s.”

There are three immigration courts inside 630 Sansome. Undocumented detainees are transported there from ICE facilities in Richmond, Bakersfield, Sacramento, and Yuba County, often roused around 3am. They aren’t allowed any books or personal property when they’re locked up awaiting court appearances, Prasad said/

“In court,” he said, “a lot of times people have their legs and hands shackled.”

Sometimes the early-morning departures and daytime detentions can disrupt medication routines, he added. That’s a problem for people taking medication to combat mental illness — especially when they’re headed for anxiety-inducing appearances in court.

 

FALSE IMPRISONMENT, REAL CONSEQUENCES

Around 5:30pm at the ICE bus blockade, the SFPD closed off the intersection and told activists they would risk arrest if they didn’t move out of the way. The larger group of supporters squeezed onto the sidewalk, but those who had set out to perform civil disobedience stayed planted where they were.

It seemed the SFPD would arrest them at any time. A police officer crouched down and spoke with them in a conversational tone as they sat with their hands clasped. “I know what you guys are trying to do,” he said, adding that he wasn’t trying to stop them from speaking out about their cause. But he asked them to stand up and let the bus get on its way. They refused.

San Francisco has been a Sanctuary City since 1989, which means city employees are prohibited from helping Immigration and Customs Enforcement (ICE) with immigration investigations or arrests except in cases where it’s required by federal or state law, or a warrant.

If they were taken into custody by the SFPD and charged with misdemeanors, the activists had reason to believe they would be spared from deportation. Added protection for undocumented San Francisco residents will soon take effect under legislation recently approved by the San Francisco Board of Supervisors.

Authored by Sup. John Avalos, it prohibits local law enforcement from honoring ICE requests to hold detainees for an additional 48 hours, except in very narrow circumstances. Federal authorities issue those requests to allow enough time to take those undocumented individuals into custody — even if they lack probable cause showing that the person was involved in criminal activity. Their status is detected via S-Comm, an information-sharing program between federal agencies that links fingerprint databases.

But a debate had apparently started between the two agencies over whether the protesters were under SFPD’s jurisdiction, or ICE’s. Prasad said federal agents threatened the activists with charges of felony false imprisonment if they did not end their protest immediately. That charge essentially means holding someone against his or her will, but “they’re not blocking the door,” he pointed out. (Some armed ICE agents, meanwhile, did happen to be standing in front of the bus door.)

The prospect of facing federal felony charges carried potentially grave consequences. Just before the start of the protest, Santos described what his own ICE bus trip had been like. He’d boarded it with about 35 other passengers, mostly men. As they crossed the Bay Bridge, he felt a pit in his stomach as he looked back at the Ferry Building, wondering if he was going to be separated from his family for good.

Santos and the other detainees were transported to Oakland International Airport, brought through a special security area, and led onto a plane. The flight stopped in Bakersfield, Los Angeles, and San Bernardino, picking up more detainees at each location. Then the flight touched down in San Diego, where some were taken off the plane and sent across the border to Tijuana.

Santos’ journey ended at an ICE detention center in Florence, Ariz. He said there were 14 bunks in a room with a single toilet, which was not well maintained. He had no idea how long he was going to remain there, but it ultimately turned out to be two weeks.

Extended family on the East Coast helped his parents locate a lawyer in Arizona, and the lawyer helped him qualify for bail, which his parents posted. He was released, and finally returned to San Francisco after 16 hours on a Greyhound bus.

Eventually, the whole matter was dropped because he benefitted from prosecutorial discretion under Deferred Action for Childhood Arrivals, federal policy enacted in June 2012 directing ICE to give special consideration to individuals who immigrated illegally to the US as children.

 

STILL UNAFRAID

Protesters at the blockade were having an intense consultation with Prasad, the Asian Law Caucus attorney, as he explained what was potentially at stake. Heads together and eyes wide as they talked it out, they ultimately opted to hold firm.

“We will do whatever is necessary for our community!” Alex Aldana bellowed into a megaphone while the supporters cheered. The group erupted into wild chanting: “Undocumented, unafraid!”

Not long after that, all were brought to their feet and led away from the bus by men in uniforms — it was federal ICE officers who escorted them away, not SFPD officers.

They brought them past the crime tape and around the corner from where the bus was parked. Then they lined them up, wrote out tickets, and let them go. Prasad said he guessed that the agency was worried about the backlash it might receive had it gone through with taking them into custody and pressing charges. Energy was high as it dawned on the activists that they were getting Certificates of Release instead of handcuffs. Still in the line police had arranged them, they jumped up and down on the sidewalk, still chanting, while a federal officer filled out the forms and placed them into their hands. As evening fell, the bus passengers remained shackled in their seats, invisible to all but the driver. Once the activists had been cleared from the scene and the authorities regained control of the situation, the bus backed up and left.

Bay Bridge turns Brown

The California Senate gave its blessing to the rename the western span of the Bay Bridge after former San Francisco Mayor Willie Brown on Sept. 12, blatantly disregarding its own rules and strong local opposition to the proposal.

Since ACR 65 is a nonbinding resolution, Gov. Jerry Brown cannot veto it even though he went on record earlier this week saying the 77-year-old bridge should keep the same name it’s always had.

San Francisco Sens. Mark Leno and Leland Yee both voted in favor of the resolution.

As the Senate gave final approval to the measure, attorneys G. Whitney Leigh and Lee Hepner filed a complaint seeking injunctive relief to overturn the resolution on behalf of their client, good government advocate Bob Planthold.

At a press conference, Planthold said the lawsuit “has nothing to do with Willie,” but rather sought to remedy what he perceived as state lawmakers ignoring their own rules, including reserving such honors for the deceased, a state of affairs he characterized as “Orwellian.”

Leigh questioned why Sacramento legislators were in such a rush to rename part of the Bay Bridge when construction of the eastern span had only just been completed, following long delays and overruns partly caused by Brown when he was mayor.

“There is a shadiness and irregularity to this procedure,” Leigh said.

The suit alleges “arbitrary suspension and/or violation of legislative rules and policies” to fast track the legislation. Specifically, Hepner said, lawmakers ignored an established timeline for introducing new proposals, instead allowing ACR 65 to be submitted four months after the formal deadline.

Formal Assembly criteria states that clear community consensus must be in place when a major piece of public infrastructure is renamed. Yet in the case of the Willie L. Brown Jr. Bridge, no such consensus exists.

Leigh is the former law partner of Matt Gonzalez, a former president of the San Francisco Board of Supervisors, who joined former board presidents Quentin Kopp and Aaron Peskin to formally call on Senate pro Tem Darrell Steinberg to stop the resolution from going forward.

On Aug. 29, the trio fired off an open letter to Steinberg in an attempt to halt the proposal from going any further, claiming “there exists significant concern in our community that naming the Bay Bridge for him is not appropriate.”

Peskin had a more colorful take on Brown and bridge when he spoke to the Guardian: “I think they should name the old eastern span, that they’re demolishing, after him. You know why? Because it’s old and crooked and a danger to society.”

Additionally, he said, the Senate Committee on Transportation and Housing was technically barred from meeting between Sept. 3 and 13 – a rule likely meant to keep lawmakers focused on more pressing issues, like approving 400+ bills before a Sept. 13 deadline – but nevertheless, ACR 65 passed out of that committee on Sept. 9 on an 8-1 vote.

Planthold previously served on the city’s Sunshine Ordinance Task Force and was previously an officer on the San Francisco Ethics Commission. Leigh is the former law partner of Matt Gonzalez, a former president of the San Francisco Board of Supervisors who joined two other former board presidents to formally call on Senate pro Tem Darrell Steinberg to stop the resolution from going forward.

Despite Gov. Brown’s opposition to renaming the Bay Bridge, it remains unclear exactly what he’ll do about it now that it has formally passed. In response to a query about whether he would take steps to halt implementation, spokesperson Evan Westrup responded in an email: “Got your message. Don’t expect we’ll be providing further comment today.”

Proposal to rename Bay Bridge draws controversy

The proposal to rename the western span of the Bay Bridge after former San Francisco Mayor Willie Brown is generating more controversy as it hurtles through the approval process in Sacramento, where lawmakers are staring down a Sept. 13 deadline before the legislative session ends.

Gov. Jerry Brown has expressed opposition to the idea, and the proposed name change prompted yet another scathing editorial from the San Francisco Chronicle. Former Mayor Brown, who also served as Assembly Speaker, publishes a weekly column in the Chronicle.

Chronicle columnists Matier and Ross reported Sept. 10 that Gov. Brown had met with Alice Huffman, a key supporter of the proposal and president of the California NAACP, about the proposed name change.

The partial renaming of the 77-year-old Bay Bridge has seen very little opposition in the state legislature, and backing from the NAACP might be a key reason why there has been such broad support from lawmakers. As it happens, Huffman has long been described as a friend of Willie Brown’s – she briefly worked for him when he was Assembly Speaker and later served as a political advisor, according to Los Angeles Times coverage.

Assembly Member Tom Ammiano opted to stay out of the fray and abstained from voting, a decision his spokesperson Carlos Alcalá explained by saying, “he’s hesitant to vote against it, because of course Willie Brown was a very important figure” in the California Legislature.

At the same time, Alcalá said Ammiano couldn’t support renaming the bridge, because “it has significant opposition,” and “he thought it was inappropriate to name it after a living person.”

A bridge so far

Pedaling onto the Bay Bridge over the weekend, I was suspended between our industrial past and sleek present. But my ride into the future was abruptly stopped just before I reached the island.

All the experts say we should all just be happy with the world’s longest bike and pedestrian pier, and it certainly is a wondrous thing to behold, this spacious and beautiful two-mile path that pasted big grins on the dozens of faces that I rode past on its sunny first Friday in operation.

But just as the duality of riding between the old Bay Bridge and the new invoked myriad metaphors, so too did the fact that my fellow taxpayers and I just spent $6.4 billion on a bridge from Oakland to San Francisco built almost exclusively for the private automobile.

Is this the future we’ve embraced? Are global warming, economic equity, and collective responsibility such distant abstractions that we can fill this beautiful new bridge with people sitting alone in expensive, deadly, polluting, space-hogging machines?

I looked into their work-weary eyes as I rode my bicycle out from Oakland with a few of my friends during rush hour, on a path wide enough to facilitate conversations among a pair of cyclists in each direction and strolling pedestrians, six abreast. It was lovely, like we had finally arrived in the civilized, people-powered present that we Guardianistas have been working toward for decades.

And then it ended, a vivid reminder that we’re not there yet.

 

SHARING THE ROAD

The past is blocking our progress, literally and metaphorically, at least for now.

The old Bay Bridge stands between the stubbed-off end of the new bike/pedestrian path and its intended touchdown spot on natural Yerba Buena Island, the conjoined twin of the artificial Treasure Island, where developers dream of building high-rise condo towers buffered against the rising sea.

Officials tell the Guardian that the path will likely be completed in early 2015, after the old bridge comes down. Then, we’ll be able to ride our bikes onto the island and cruise our way to the west side, with its beautiful views of our beloved city, San Francisco, shimmering just out of reach.

Next month, the Metropolitan Transportation Commission will release its latest study of how to complete the ride/walk, examining the placement of pathways balanced on either side of the Bay Bridge’s western span, their added weight compensated for with lighter decks for the cars, all at a cost approaching a billion bucks, with a capital B.

“Everything about this is going to be hard,” MTC spokesperson John Goodwin told me when I asked about allowing cyclists and pedestrians onto the Bay Bridge’s western span, citing an array of engineering, financial, and political obstacles.

“It’s a 10-year project even if a local billionaire decides to put up the money,” Goodwin said, noting that there is no public funding identified for the project except for maybe raising automobile tolls again, which would be a tough sell to voters for a bike and pedestrian project. “It’s an uphill climb and I’m not sure it will ever reach its intended goal.”

But completing this journey is really only as difficult as we make it. Just ask local activist/author Chris Carlsson, who says that he and some of his buddies could fix the problem in a day for a few thousand dollars. All we need to do it take the righthand lane, install some barriers, done.

“The bridge is more malleable than people treat it as and we need to have this discussion publicly,” Carlsson, a founder of Critical Mass and author of Nowtopia, told us. “Let’s solve this problem today. The idea that they would open this bridge without completing this path is insulting.”

To Carlsson and others of his radical ilk, this is an equity issue, and the opening of a car-only bridge is symbolic of our societal myopia. To believers in the automotive status quo, the idea of giving up one of five traffic lanes for the final, two-mile-long descent into San Francisco makes their heads explode.

“That’s just wildly unrealistic,” Goodwin said of Carlsson’s idea, even instituted on a temporary basis, noting that the Bay Bridge handles more than 270,000 cars per day, by far the busiest state-run bridge in California.

To many modern minds, automobiles are essential to our personal freedom and economic vitality — bikes are toys, public transit is for the poor, walking is what you do in your neighborhood or on the treadmill at the gym — but San Francisco is a voter-approved “transit-first” city that supposedly gives each of these modes priority over cars.

“The idea that the five lanes of automobile traffic is inviolable is ridiculous,” Carlsson said, calling it a relic from the days before the freeway revolts of the 1950s and ’60s, when San Franciscans rejected the conception of The City as just another stop along the fast and efficient interstate highway system.

In fact, it was that cars-first vision — before it was rejected by a populist revolt — that helped lead officials to remove the passenger trains that operated on the lower decks of this New Deal/WPA bridge for its first 17 years of life, turning the whole Bay Bridge over to cars, trucks, and the occasional bus.

The era of unfettered automobility had begun, and the idea that capitalism/industrialism and the health of our world might someday, somehow come into conflict with one another also seemed wildly unrealistic.

 

BRIDGING THE GAP

The Bay Bridge was my bridge growing up in the East Bay, our link to the big city that I traversed while safely cocooned in the backseat of my parents’ car, windows up, car filled with what we’d later call secondhand smoke, buffered against the wilds of West Oakland as we launched over the bay.

Today, my perspective has changed and so has my access through the old industrial waterfront, which has been opened up to all by a pair of new paths leading bikers and hikers to the bridge, both short rides from the West Oakland BART station.

One starts on Maritime Street, near the Port of Oakland and the remnants of the old railyard on what the Realtors have started calling Oakland Point; the other starts on Shellmound Street right across from Ikea, best accessed from West Oakland along 40th Street, where crews were in the process of placing tall cones to protect the bike lane as we rode past.

After the trails merge, it proceeds past the yards for the government agencies set up to serve the motoring public: CalTrans and its freeway maintenance facilities, and the California Highway Patrol, which has doubled its local bicycle brigade (which had worked just the Golden Gate Bridge) to police the new path.

“Best job in the world,” a smiling Officer Sean Wilkenfeld told me as he arrived at the end of the Bay Bridge path, where a couple dozen people stood watching the new Bay Bridge and the old, which took on a ghostly feel as we hovered next to its newfound lifelessness.

Personally, I really like the new Bay Bridge, with its elegant modern architecture and unobstructed bay views. But some of the friends and strangers that I chatted up there at the end of the line disagreed, singing the praises of the old, industrial, seismically unsound original.

“The new bridge is beautiful, but in some ways I like the old bridge better because you can see its functionality,” Joel Fajans, a physics professor at UC Berkeley, told me.

Conversation among the cyclists turned to our beautiful new path and its untimely end. “What a dream come true to have a bike path on the Bay Bridge. I already wrote to my representatives about completing the route to San Francisco,” said Kurt Vogler, a 47-year-old environmental consultant from Oakland who rode the bridge with Fajans.

That was the phrase that everyone used, this notion of completion, conveying the sense that we’re somehow stuck between where we were and where we should be, suspended between the old and the new, waiting to catch up.

“I think it’s beautiful. It’s an engineering marvel, a miracle,” Garris Shipon, a engineer from Berkeley, said halfway through his bike ride on the Bay Bridge. “I’m glad they launched with a bike path at all, and I hope they finish it because I’d love to ride all the way across.”

 

 

TWO BRIDGES

The San Francisco-Oakland Bay and Golden Gate bridges were built at the same time, started in 1933. But the Bay Bridge — the industrial, utilitarian bridge connecting The City to its biggest, most diverse nearby population centers — was done first. The tall, pretty one — with its Art Deco flourishes and tourist appeal — took longer.

On its opening day, the Golden Gate Bridge was filled with pedestrians, while the Bay Bridge hosted its first traffic jam as it was unveiled, “with every auto owner in the Bay Region, seemingly, trying to crowd his machine onto the great bridge,” the San Francisco Chronicle reported.

It’s been the same story ever since, with cyclists and walkers crowding onto the Golden Gate daily, salty winds howling through their hair, while travelers on the Bay are caged behind steel and glass.

But not anymore. In fact, it’s far more pleasant to ride on the Bay than the Golden Gate, where the bike path is narrow and cluttered. Now, it’s the golden one that seems to belong to another age, with the Bay Bridge designed to be personally experienced.

“It’s really a spectacular excursion,” Renee Rivera, executive director of the East Bay Bicycle Coalition, told me. “I was taken by surprise by what fun it is to be on a bike on that bridge.”

But the stirring sensation of riding or walking the Bay Bridge only accentuates its main shortcoming; at least the noisy, harrowing Golden Gate Bridge goes all the way across.

“We just spent $6 billion on that,” Fajans said, gesturing to the new Bay Bridge, “and you’re saying we can’t spend a little more to complete the bike lane? That’s not fair.”

Goodwin and others say that motorists paid for the new Bay Bridge with their tolls, but Fajans calls bullshit, noting that BART passengers pay more than drivers for a round trip across the bay without buying exclusive access in the future.

In this age of austerity, with government funding for transportation projects drying up and people reluctant to raise their own tolls or taxes, it’s hard to do what’s needed. That’s one reason cycling advocates take what they can get, such as an expensive western span proposal with one of two paths reserved for maintenance vehicles to smooth the automotive flow.

“If we have to sell it to the public to increase tolls, we’ll have to show that it benefits everyone,” Rivera said.

Completing this path, somehow, is a top priority for the cyclists.

“It was a little tough to get people’s attention on the western span for the last couple years, but now is the time,” Leah Shahum, executive director of the San Francisco Bicycle Coalition, told us.

Neither director seems willing to embrace Carlsson’s radical approach of simply seizing a lane.

“Like Chris, we feel strongly about equity on the bridge,” Rivera said. “At the same time, it needs to function smoothly as a bridge and I would be concerned about it bottlenecking at Treasure Island.”

Carlsson rejects the neoliberal approach of begging for scraps as we ride into a future that simply can’t continue to be dominated by automobiles. He says the Bay Pier must not rest there for another decade.

“Both bike coalitions have a resistance to appearing anti-car,” Carlsson says, “so they aren’t willing to say the obvious thing.”
