A century after the Raker Act, San Franciscans are still illegally denied public power

The San Francisco Examiner has a good story on today’s 100th anniversary of the signing of the Raker Act, federal legislation that allowed San Francisco to build a dam in Hetch Hetchy Valley, a campaign championed most fervently at the time by the Examiner’s then-Publisher William Randolph Hearst.

The article was a good roundup of issues related to the Raker Act, and it included ongoing efforts by the group Restore Hetch Hetchy to try to tear down the dam, but there was a key aspect of the Raker Act that the Examiner left out, one that has been championed by the Bay Guardian over the years.

The Raker Act specifically called for San Francisco to directly distribute the water and electricity generated by the O’Shaughnessy Dam to its residents and for their benefit. The city does so with the water, through the San Francisco Public Utilities Commission, but Pacific Gas & Electric used its power and connections to take control of the electricity and keep it, corrupting the political system for nearly a century in the process.

“The result: San Francisco has paid through the nose to PG&E for its power and the city loses about $30 million a year in profits it would get from a public system,” journalist J.B. Neilands wrote in the March 27, 1969 issue of the Bay Guardian, the first of dozens of stories we’ve written on the topic, spanning many unsuccessful public power campaigns, each one dominated by millions of dollars in PG&E spending.

Section 6 of the Raker Act says that the city “is prohibited from ever selling or letting to any corporation or individual, except a municipality or municipal water district or irrigation district, the right to sell or sublet the water or the electric energy” generated by the dam.

That long-standing violation could become an issue that threatens San Francisco’s control over its main source of clean water and power if Save  Hetch Hetchy gains traction in the courts with a lawsuit that it is pledging to file.

While PG&E doesn’t wield the same strong influence that it once did at City Hall, thanks partly to years of aggressive overreach that soured many local officials on the powerful utility, it does still retain close ties to former Mayor Willie Brown (an attorney who has been on retainer with PG&E for years) and current Mayor Ed Lee, who has sabotaged the latest half-step toward public power, CleanPowerSF.    

Media misses connection between BART tragedy and settlement

BART continues to stonewall important questions about whether it was training scab drivers to break the recent strike by its unions when its trainee-driven train killed two workers on Oct. 19 — a stance made possible by the failure of the mainstream media to connect the dots or correct the anti-union bias that characterized its coverage of this long labor impasse.

The failure of local journalists to highlight the connection between that tragedy and the subsequent decision by the district to suddenly soften its stance and sweeten its offer — within hours of the National Transportation Safety Board revealing that a trainee was driving and that BART’s “maintenance run” story was a deception — is as myopic as it is appalling.

After all, the daily newpapers, television stations, and wire services did finally, dutifully report that a trainee was driving, even as they failed to point out to readers and viewers the significance of that disclosure or ask the district, “Why were you training drivers during a strike? Were you planning to offer service during the strike?”

We have asked those questions of the district, and when we got misleading obfuscations, we asked again and again, and our questions are still being largely ignored (actually, we just got a limited but important response, see below). And here’s why they matter: Because if the district was planning to run trains during the strike, it reinforces the unions’ contention that the district was hard-bargaining to force a strike that it was preparing to break, a plan that became untenable when two people died, just as the unions warned might happen if the district ran trains without experienced drivers.

This should be a huge scandal, the kind of thing that might force General Manager Grace Crunican to resign and BART directors to lose their seats — except for the fact that the media is ignoring this simple, obvious narrative and failing to do its job.

The East Bay Express, which today published an excellent article on how the San Francisco Chronicle and Bay Area News Group (which includes the Oakland Tribune, Contra Costa Times, and San Jose Mercury News) mislead the public about the BART standoff, is the only other media outlet in the region to join the Bay Guardian in highlighting the relevant facts in this story.

Not only have these newspapers written some truly atrociously anti-worker editorials, but even the supposedly objective news stories have been clearly biased in their emphasis and omissions. Why else would they repeatedly emphasize a proposal by an obscure Republican member of the Orinda City Council to prohibit future BART strikes — a bit of election-related grandstanding that has no chance of passing in Democrat-controlled Sacramento — while failing to analyze why BART suddenly sweetened its offer beyond what Crunican said the district could afford?

But this could be a situation that backfires on local media managers considering that the truth will probably come out eventually, even if it’s long after the media spotlight has moved on. NTSB investigations can take up to a year, but they are remarkably thorough and it will probably eventually discuss why these drivers were being trained.

The Assembly Committee on Labor and Employment announced yesterday that it will also hold a hearing to “get to the bottom” of the tragedy, and one can only hope that someone on that committee will grill the district about its intentions in running that ill-fated train and conducting new driver training just one day into the latest strike.

UPDATE: As I was posting this story, I finally heard back from BART spokesperson Alicia Trost, who made it sound like preparations to break the strike weren’t news — even though it may be news to most newspaper readers.

“The District has publicly acknowledged, dating back to a September 13, 2013 Metropolitan Transportation Commission subcommitee meeting, that BART has been training some non-union employees to operate limited passenger train service in the event of an extended strike if so authorized by the Board of Director. The Board was never requested to authorize revenue service during the strike,” she wrote by email.

Yet those public aknowledgements don’t appear to have made it to the public. And when the Chronicle’s Matier & Ross did run an anonymously sourced item breaking the news that BART may be training replacement drivers, BART refused to comment, the duo soft-peddled the scoop, and the relevation failed to make it into the larger narratives the newspaper offered about BART.

And even now, Trost followed up her admission by minimizing its importance, saying that the ill-fated train was also being run for maintenance purposes, which the NTSB had also reported.

“BART has to ‘exercise the system’ by running trains on the tracks to prevent rust build up. Rust can build up quickly and will interfere with train service. BART continued to run inspection trains throughout the entire strike just as it did during the July strike,” she wrote.

But the real issue is whether the district deliberately triggered two strikes that the heavily impacted public angrily blamed on workers, thanks largely to how the standoff had been cast by the mainstream media and the district. After all, BART chose a notoriously anti-union labor consultant as its lead negotiator, a decision that even Willie Brown criticized in his Sunday column, although Brown cast the district as just dumb instead of intentionally forcing a strike.

I’m still waiting for Trost to answer my follow-up questions, and I’ll update this post if and when I hear back. I’m also still waiting to hear from BART Board President Tom Radulovich, whose progressive credibility has been tarnished in the eyes of some for playing such a lead role in BART’s media strategy.

Thankfully, the divisive standoff between BART and its unions seems to be over, but the questions about what really drove it and how its conclusion came about are still relevant and largely unanswered. And that says a great deal about the state of journalism today.

BEST OF THE BAY 2013: LOCAL HEROES

Bruce Brugmann, Jean Dibble, and Tim Redmond

The San Francisco Bay Guardian — which has had a significant impact on the Bay Area’s cultural and political dynamics and dialogue over the last 47 years — was largely the creation of three people with complementary skills and perspectives, an amalgam that gave the Guardian its voice and longevity.

Although they are no longer involved with running the paper, we’re honoring their contribution and legacy with a form of recognition they created: a Local Hero Award in our Best of the Bay issue, an annual edition that has been adopted by almost every alt-weekly in the country.

Bruce Brugmann and Jean Dibble launched the Guardian in October 1966 after years of planning by the married couple, and they ran it as co-publishers until the paper’s sale to the San Francisco Newspaper Co. last year, with Dibble running the business side and Brugmann in charge of editorial and serving as its most public face.

“We were one of the few husband and wife newspaper teams, a real mom and pop operation,” Brugmann told us. “We couldn’t have done it without the two of us, we needed both of our skill sets.”

They met in 1956 at the University of Nebraska, where Brugmann studied journalism and served as editor of the Daily Nebraskan, starting his long career as journalistic rabble-rouser. Dibble studied business, which she would continue in graduate school at Harvard University’s Radcliffe College while Brugmann got a master’s in journalism at Columbia University.

As graduation neared, they started talking about forming a newspaper together, an idea that percolated while Brugmann served in the US Army, where he wrote for Stars and Stripes, and Dibble moved to San Francisco with their two kids to work in personnel and administrative positions.

After the Army, they settled in Wisconsin, where Brugmann worked as a reporter for the Milwaukee Journal before moving to the Bay Area to work on launching the Guardian while Brugmann supported the family working for the Redwood City Tribune.

“We came out here with the idea of doing it and we immediately started planning. Jean did the prospectus, a damn good prospectus,” Brugmann said.

The Guardian published sporadically in the beginning, but it tapped into a vibrant counterculture that was clashing with the establishment and began publishing important articles highlighting inequities in the Vietnam War draft and exposing local political scandals, including how Pacific Gas & Electric illegally acquired its energy monopoly.

“A lot of it was just keep your head down and keep going,” Dibble said. “We never talked about alternatives, it was just what we were going to do.” The Guardian covered the successful revolts against new freeways in the city and plans to build Manhattan-style skyscrapers, publishing the book The Ultimate Highrise in 1971. In the mid-’70s, the Guardian won a successful unfair competition lawsuit against the Chronicle and the Examiner over their joint operating agreement, allowing the paper to become a free newsweekly. “Eventually, things got better, and we got some large advertisers in the ’80s and they really helped kick us off,” Dibble said. That was also when Tim Redmond, a journalist and activist steeped in radical politics, started writing for the Guardian, going on to serve as the paper’s executive editor and guiding voice for more than 30 years. “Tim was always more radical than I was,” Brugmann said, giving Redmond credit for the Guardian’s groundbreaking coverage of tenant, environmental, and economic justice issues. “Every publisher needs an editor who was more radical than they are to push them.” The two journalists had a prolific partnership, mentoring a string of journalists who would go on to national acclaim, turning the Guardian into a model for alt-weeklies across the country, exposing myriad scandals and emerging arts and cultural trends, and helping to write and pass the nation’s strongest local Sunshine Ordinance. “We always wanted to make things better,” Brugmann said of what drove the Guardian. “Even the battles that we lost, we got major concessions. Yerba Buena is much better because of the stories we did at the time, same thing with Mission Bay…San Francisco is much better that we were here. And we’re really proud and we appreciate the work of the current Guardian staff in keeping the Guardian flame alive.”

 

LOCAL HEROES: Kate Kendell

The night Proposition 8 passed was one of the hardest of Kate Kendell’s life. She remembers it with startling detail — and she should, because she was one of the most prominent opponents of the measure to overturn marriage equality in California.

“I was hopeful right up until the end that Prop. 8 would be defeated,” she said, speaking slowly as she pulled her thoughts from what sounded like a dark place. “Our initial polling numbers said we’d probably lose, but I really hoped in the deepest heart of my heart that when people got in there that they’d punch their vote in favor of the person they knew.”

But as the voters of California showed in that 2008 election, sometimes the good guys lose.

Kendell, executive director of the National Center for Lesbian Rights, fought the good fight since she started there in 1994. The NCLR litigates, creates policy, and performs outreach for LGBT civil rights on a national level, with headquarters in San Francisco. After years of anticipation, she poured herself into the campaign against the proposition that would make her marriage illegal, and then the measure passed.

That night she hung her head in disbelief. She felt physically ill, and her mind roiled in grief equaled only by the death of one of her parents. “It felt like that,” she said.

Kendell and her wife, Sandy, went home without speaking a word, and when she got in the door she tried to pull it together. Steeling herself to face her family, Kendell walked out of the bathroom and burst into tears. Her son said simply “this just means we have to fight more.”

So she did, and we all won.

That led to the moment for which Kendell may be remembered for a long time to come. When Prop. 8 was overturned by the US Supreme Court this year, a flock of San Francisco politicians descended the steps inside the rotunda at City Hall. Kendell took to the podium and spoke to the nation.

“My name is Kate Kendell with the National Center for Lesbian Rights,” she said, “and fuck you, Prop. 8!” The crowd erupted into cheers.

She regrets saying it now, but history will likely forgive her for being human. For someone whose own marriage’s validity was threatened and who spent two decades fighting for equality, she earned a moment of embarrassing honesty.

Kendell’s infamous declaration may be how she’s known, but one of her key decisions behind the scenes shaped the LGBT equality movement as well. When then-Mayor Gavin Newsom’s administration wanted a couple to be the first in his round of renegade gay marriages in 2004, it was Kendell who suggested Del Martin and Phyllis Lyon.

The two were in a relationship since 1953, pioneers of LGBT activism in San Francisco. Kendell said it was only right that they were first to read their vows in the city they helped shape. “Were it not for their contributions, visibility, and courage in the ’50s and ’60s, we wouldn’t be in that room with Newsom contemplating marriage licenses,” she said. “I’m just happy they said yes. It was absolutely appropriate.” And it’s with that sense of history that she herself pioneers forward, pushing in states across the US what Harvey Milk fought for in California — workplace protections for the LGBT community. “In 38 states, you can be fired from your job or being lesbian, gay, bisexual, or transgender. That has to change,” she said. “When the next chapter of history is written, it will be about a nation that treats the LGBT community as equals.”

 

Theo Ellington

Last year, when San Francisco Mayor Ed Lee floated the idea of implementing stop-and-frisk, a practice that many civil rights advocates say amounts to racial profiling, Theo Ellington stepped up to create a Change.org petition to oppose the idea — and won.

The policy would have given San Francisco police officers the authority to stop and search any individual who “looks suspicious,” in an effort to get guns off the streets.

“I found it was basically a predatory policing practice that didn’t belong in a city like San Francisco,” Ellington told us. His petition garnered a little more than 2,300 signatures, “enough to show policymakers we were paying attention,” he guesses. Faced with mounting pressure and a community outcry, Lee ultimately abandoned the idea.

“That was a win, I think, for everyone fighting for what’s really a civil right,” the 25-year-old, native San Franciscan told us in a recent phone interview. “It’s not a black issue or a white issue,” but it did strike a nerve and provide Ellington with some momentum for coalition building.

Ellington was born and raised in San Francisco’s Bayview Hunters Point neighborhood, home to a significant portion of the city’s dwindling black population. The campaign against stop-and-frisk helped catalyze his still-evolving political organization, the Black Young Democrats of San Francisco, of which he is president.

Go to BYDSF’s website and you’re confronted with some startling statistics about the experience of black San Franciscans: In the last 20 years, the African American community has dwindled to only 6 percent of the city’s population; meanwhile, the high school dropout rate stands at 38 percent, the unemployment rate is 18 percent, and the level of poverty stands at a disheartening 20 percent.

To tackle these looming challenges, BYDSF now faces the hurdle of getting local elected officials to care. “Since then, we have been trying to build our membership and figure out where we fit in the political climate of SF,” Ellington says.

His group’s chief concerns include closing the achievement gap in San Francisco public schools, doing something about the escalating cost of housing, and finding better solutions for public transit. “There’s the housing need, obviously. It’s a need that working class folks in general are facing,” he said.

He’s pursing a master’s degree in urban affairs at the University of San Francisco, and says he’s taken it upon himself to learn everything he can about how cities operate. To that end, he often ponders vexing questions: “How do you figure out a way to give those same opportunities to everyone? How do you provide opportunities for all income levels?”

His successful opposition campaign to stop-and-frisk didn’t stop Mayor Lee from appointing him to the Commission on Community Investment and Infrastructure, which oversees the successor to the San Francisco Redevelopment Agency. A major project under that body’s purview is the Hunters Point Shipyard development, a massive undertaking led by construction firm Lennar Urban, practically in Ellington’s backyard. Having grown up in the neighborhood, he sees himself as being in a unique position to ensure that the developers are providing jobs for local residents as required under the agreement. “It allows me to speak to both sides — on the community level, and in City Hall,” he said. “There are certain social dynamics you won’t understand unless you have lived in the community.” Ultimately, Ellington says, his goal is to push local politicians to find ways of making San Francisco a place where people of all income levels can find their way. “There’s a lot more work to do,” he said. “I think San Francisco is at a real pivotal point, where we can choose to go in the right direction … or we can choose the opposite.”

 

LOCAL HEROES: Shanell Williams

Shanell Williams is a chameleon activist, spearheading the effort to save City College of San Francisco from many fronts.

When City College fought off a statewide initiative to save money by stigmatizing struggling students, she defended the school as an Occupy activist. With a banner raised high, she faced down the California Community College Board of Governors, shouting their wrongs aloud at a meeting attended by hundreds. The board was stunned but her fellow activists were not, because that’s who Williams is: an uncompromising defender of San Francisco.

Now, as City College faces a fight for its existence, Williams is defending it again, this time as a duly elected CCSF student trustee.

Williams is at the forefront of Save CCSF, an Occupy-inspired group publicly protesting the Accrediting Commission of Community and Junior Colleges, the body trying to shut down City College. San Francisco is holding its breath until next July to hear if the accrediting commission will close the city’s only community college — and Williams was one of the key organizers helping students’ voices rise up to decry the decision to close the school.

She has reason to fight hard, growing up watching her community ravaged by those in power who purported to do good. She is a black woman and San Francisco native raised in the Fillmore and the long history of redevelopment and its role in the flight of The City’s African American population shaped her ethos. To Williams, there are forces that care about money at the expense of communities and those forces need to be fought.

“How are we supporting people to have a decent quality of life?” she said, and that’s the way she’s approached saving her community since a young age.

In 2003, while in high school, Williams got a taste of politicking as a member of San Francisco’s Youth Commission, appointed by then-Mayor Willie Brown. “I think he’s a very interesting character with a lot of influence over the city,” she said, with just an edge of steel to her voice.

As a teenaged politician, she discovered the work of the Human Rights Commission and was inspired. While a student of Washington High School and then Wallenberg High, she had a tough home life and entered the foster care system, getting a firsthand look at how the state takes care of its youth.

It galvanized her, honed her, and made her yearn for change. “I just innately had a sense of wanting to see justice and fairness,” she said.

Energized, she joined the Center for Young Women’s Development, the Youth Treatment Education Court, Urban Services YMCA, the Youth Leadership Institute, and more. She joined so many organizations and taught so many youth and government officials that even she can’t remember all of them off the top of her head.

At one point, she even taught judges across the country about cultural competency. “We had this whole spoken word performance thing we did,” she said, laughing.

In 2010, as Williams took classes at City College, she waved the banner defending San Francisco’s community college students. She pushed for city-level minimum wage requirements for City College workers, who earned dollars less. She also pushed back against state requirements to cut off priority registrations to those who took too long in the community college system — because she’s been there herself.

“They need a few chances to get it right and become a good student,” she said. When the struggle to save City College is done, win or lose, Williams sees herself remaining an advocate for students for years to come. At 29 years old, she’s still a student herself, and she eagerly awaits the day she’ll transfer to Cal or Stanford as an Urban Studies major. It all comes back to defending her city. “We have to broaden the movement,” she said. “The enemy is not about color, it’s about wealth inequality. It’s not just about City College either. It’s about the austerity regime that doesn’t care about working class people and poor folks.”

 

San Franciscans for Healthcare, Jobs, and Justice

When the San Francisco Mayor’s Office cut a deal with Sutter Health and its California Pacific Medical Center affiliate for an ambitious rebuild of hospital facilities — which would shape healthcare services in San Francisco for years to come — community activists began to find serious flaws in the proposal.

So they organized and banded together into a coalition to challenge the powerful players pushing the plan, eventually helping to hash out a better agreement that would benefit all San Franciscans. Representing an alliance between labor and community advocates, the coalition was called San Franciscans for Healthcare, Jobs, and Justice.

When the whole affair began, it seemed as if the CPMC rebuild would incorporate a host of community benefits — but those promises evaporated after the healthcare provider walked away from the negotiating table, unhappy with the terms.

Then a second agreement, with much weaker public benefits, came out of a second round of talks between CPMC and the Mayor’s Office. But by then, so much had been given up that “we were stunned,” said Calvin Welch, who joined the coalition on behalf of the Council of Community Housing Organizations. “We met with [Mayor Ed Lee] and told him, this is absolutely unacceptable.”

But the mayor wasn’t willing to address their concerns at that time. When the deal failed to win approval after a series of hearings at the Board of Supervisors, however, “the unacceptable deal that the mayor created melted in the sun of full disclosure,” Welch said.

That plan would have allowed St. Luke’s Hospital, a critically important facility for low-income patients, to shrink to just 80 beds with no guarantee that it would stay open in the long run. CPMC’s commitment to providing charitable care to the uninsured was disappointingly low. And while the project was expected to create 1,500 permanent jobs in San Francisco, the deal only guaranteed that 5 percent of those positions would go to existing San Francisco residents.

Enter the movers and shakers with San Franciscans for Healthcare, Housing, Jobs, and Justice. The coalition took its place at the negotiating table, along with CPMC, a mediator, and an unlikely trio of supervisors that included Board President David Chiu and Sups. David Campos and Mark Farrell. Over several months, the coalition put in some serious time and energy to push for a more equitable outcome.

“We pushed so hard for a smaller Cathedral Hill [Hospital] and a larger St. Luke’s,” Welch said, describing their strategy to safeguard against the closure of St. Luke’s. They also pushed for CPMC to make a better funding contribution toward affordable housing, a stronger guarantee for hiring San Franciscans at the new medical center, and improvements to transit and pedestrian safety measures as conditions of the deal.

Under the terms that were ultimately approved, St. Luke’s will remain a full-service hospital, and CPMC will commit to providing services to 30,000 “charity care” patients and 5,400 Medi-Cal patients per year.

CPMC also agreed to contribute $36.5 million to the city’s affordable housing fund, and promised to pay $4.1 million to replace homes it displaces on Cathedral Hill. Under the revised deal, 30 percent of construction jobs and 40 percent of permanent entry-level positions in the new facilities would be promised to San Francisco residents.

One of the greatest victories of all, Welch said, was how well coalition members worked together. “This was the most straight-up equal collaboration with labor and community people, equally supporting one another, that I’ve ever been involved with,” Welch said. Even though they were motivated to participate by different sets of concerns, the two sides remained mutually supportive, Welch said. During the long, grueling hearings, “The nurses never left,” he noted in amazement. “The nurses stuck around for all the community stuff.”

No room left in San Francisco for an artist who helped make the Mission what is

After four decades living and creating art in the Mission, iconic San Francisco artist and curator Rene Yañez is being threatened with eviction.

Yañez made local history in 1972 when he brought Dia de los Muertos, the Mexican holiday honoring the dead, to San Francisco. The parade through the Mission District every Nov. 2 quickly became a Bay Area tradition, drawing thousands of people each year.

He founded the Galeria de la Raza and brought Latin America’s premier artists and photographers to showcase their work there. When the Museum of Modern Art rejected the work of a little-known Mexican woman, it was Yañez who gave a young Frida Kahlo a space to exhibit her paintings. He taught art classes for youths in the community and offered crucial support to many of the Mission’s mural projects.

In 1998, the San Francisco Foundation awarded Rene the “Special Trustees Award in Cultural Leadership.” Now, the man who has contributed so much to the culture of this city finds himself on the verge of being expelled from it.

Rene’s impending eviction from the house on San Jose Avenue where he has lived for the for 35 years is producing a fierce reaction. Fellow artist and personal friend Guillermo Gómez-Peña recently released an open letter expressing his outrage and rallying for public support of Rene’s cause.

“You are being physically and culturally evicted,” Gómez-Peña writes. “Shame on this city! Shame on the greedy landlords and politicians! Your sadness is ours…A city without Rene Yañez…can’t be called San Francisco.”

Gómez-Peña’s cry to action will be answered tomorrow (Sat/12) at 2pm at the Brava Theater on 24th Street with Our Mission: No Eviction, a march in protest of the Ellis Act, the law used to evict all of the tenants living in the five-unit house on San Jose, including Rene, his partner Cynthia, his former wife Yolanda, and his son Rio. On Saturday, Oct. 26, Brava Theater in the Mission will host “Our Mission: No Eviction!” a fundraiser in honor of Rene and Yolanda featuring art and performances.  All proceeds from ticket sales to the event will go to the legal expenses of fighting the eviction, as well as Rene and Cynthia’s medical bills; both the artist and his partner are currently battling cancer.

“They were kind of at peace that this would be their home when they passed away, in the community they’ve put so much into,” Rio told us. “Cynthia could be dying or dead while they are in the process of moving.”

Under the Ellis Act, Rene and Cynthia qualify for a year-long postponement of their eviction because of their illness, a fact which their landlord, Sergio Iantorno of Golden Properties, LLC, neglected to tell Rene when he offered him $21,000 and a years’ free rent if he accepted his eviction immediately.

Consulting his lawyer, Raquel Fox, Yañez was informed about the legal extension and proceeded to successfully apply for it. Even without her advice, though, Yañez would not have accepted Iantorno’s offer. As Rio explained, that amount is nowhere near enough for Rene and Cynthia Yañez to get another place in San Francisco, especially in the neighborhood that they call home.

“They are in their 70s. They aren’t looking for a huge buyout so that they can start a new life,” Rio told us.

When their original landlord died 13 years ago, Yañez and his fellow tenants pooled their money to make a bid for the house. Golden Properties saw their offer, and doubled it. Now, they are banding together again to refuse Iantorno’s money and fight  the eviction.

“I would rather take my chances and fight it,” Yañez told the Guardian. “And also I see it as resistance to what is going on and affecting a lot of people.”

On Oct. 1, the San Francisco Rent Board released its Annual Statistical Report for fiscal year 2012-2013. The report revealed a 36 percent increase in eviction notices since the year before. Evictions from rent-controlled apartments in particular are at an 11-year high.

The Ellis Act was used 81 percent more than last year, providing the basis for almost 10 percent of all evictions. The law was used with greatest frequency by landlords in the Mission District. Meanwhile, city public health officials estimate that someone earning minimum wage would need to work more than eight full-time jobs to be able to afford a two-bedroom apartment downtown.

“It is a disaster,” states Christopher Cook, an organizer with the nonprofit group Eviction Free Summer. “Individuals, families, and increasingly small businesses are being hammered by these twin tsunamis of evictions and dramatic rent increases. Those two factors have been driving people out of the city in ever greater numbers for the past 10 to 15 years.”

Gómez-Peña blames these changes on the mass of high-paid young people produced by the second dot-com boom. They may work in Silicon Valley, but they play in San Francisco, and this new class of wealthy young techies can and will pay any price to live in the city—especially the Mission District.

“I see them everyday, the hordes of iPad and iPhone texting zombies, oblivious to us and our lives, our inspirations and tribulations,” he writes. “I see them in my building and on the street, invading the city with an attitude of unchecked entitlement, taking over every square inch and squeezing out the last drops of otherness.”

It is no easy task to make room for all that wealth when the majority of the city’s residents are renters protected by law against unfair rent increases, landlord mistreatment, and unwarranted evictions. The actual strength of these safeguards may be waning, though, leading Gómez-Peña to warn the public in his letter that, “As renters our hours here are numbered.”

The only way to evict a tenant in San Francisco is by claiming one of 15 “just cause” reasons for removing them. Among those 15, the Ellis Act is something of a landlord’s dream date, skipping all the talking to get straight to the action—eviction. Established in 1985, the California law gives landlords the unconditional right to evict tenants if they are “going out of business.”

In order to implement the Ellis Act, a landlord must evict all of the tenants in his or her building, giving them 120 days notice, and wait five years before they can put the units back on the rental market at an increased price. However, the law does not prevent landlords from renting the units out as short-term lodgings, or converting them to be sold as one massive unit, tenancies in common or condominiums.

“Ellis Act evictions are impossible to fight,” admitted Ted Gullickson, the head of the San Francisco Tenants Union. This makes them an ideal weapon against rent control, which has allowed residents from lower income brackets to hold onto their homes in San Francisco for decades while the values of the real estate grew and grew. Even then, many tenants do not feel secure. Guerra has heard stories about people with rent control living for decades without hot water, working windows, heat, or even a stove. “To have this amazing rent control,” she concludes, “they put up with substandard living.”

When something broke in their building, Yañez and his family often did not even tell the landlord about it. If they did ask him to fix something, and he ignored their request, no complaints were ever made. “Because of rent control, we tried to keep a low profile,” Yañez acknowledges. “We tried not to bother the landlord or make too much of a fuss, because we did not want to find ourselves in this position.”

Rene has been aware of how precarious his situation is for years. Iantorno attempted to evict him multiple times. He watched as neighbors, nonprofit organizations, and local artists accepted their own eviction notices without a fight. When he first opened the Galeria in 1970, Yañez had a list of artists living in the Mission that neared 200 names. Today, it does not even reach 20.

“Since 2000, they’ve started this thing in the Mission,” he states. “They were very quiet about it at first, but now it’s accelerating. Willie Brown started it, this trend of redevelopment, eviction, displacing people without consideration. He opened up this gaping wound in the Mission, and now these developers are throwing salt on it, trying to kill the patient,” he chuckles. “People get really upset when somebody paints over a mural, like, ‘It has history, it has value, it’s been here for years,’ but they don’t have anything to say if the muralist gets evicted.”

Legally, there is not much that Yañez and his family can do in the coming year to stop their eviction. Even an advocate like Cook admits, “You can’t reverse an Ellis Act. All you can do is fight it, try to make it clear that it’s not worth the landlord’s while, that they’re gonna be in for a world of headaches, costs, and public shaming if they do this.”

Yañez has not accepted the eviction, but he is preparing for the worst, searching for a new home for Cynthia and himself. He continues to scour the Mission, in vain. “I love the Mission,” he explains. “I’ve been there 40 years. I adopted it, it adopted me. And it needs cultural preservation,” he says, curling his hands into fists that bang the air. “We saved the community from really greedy people who had absolutely no interest in who we were as a people. They just saw us as savages standing in the way of them making money. That attitude is still here. It’s actually worse than ever—unregulated and devastating. When I see the trucks moving people out, older people who have no idea where they’re going, sometimes they go downtown to the hotels—I just think it’s really heartless,” he finishes, his eyes wide in earnesty.

Guardian of San Francisco culture that he may be, Rene and Cynthia Yañez will be forced to leave the city in search of somewhere more affordable if their eviction occurs. In that event, there is little chance that the elderly man will be able to return to the city to curate SOMArts annual Dia de los Muertos exhibition as he has every year since he began it.

“I’m hoping that I can hang in. It’s a throw of the dice, but I still have some miles left in me,” he says, his eyes drooping wearily.

There is a chance that the exhibition, which opened today (Friday/11), might be Yañez’s last. Every year, he changes the theme. This November, the Dia de los Muertos exhibition is dedicated to all the living battling cancer, and  all the dead for whom that battle is over. Each piece is haunting, and all together it is a stunning collection encompassing a range of ages and races to touch any and every person that sees it. Like a loved one lost to cancer, the exhibit leaves you wanting more, yet so grateful fpr what you have experienced.

His last or not, it is something that Yañez can be very proud of.

Friends in the shadows

It’s a simple fact of life: Money buys influence. But in San Francisco, despite strict sunshine laws to illuminate donations to city agencies and gifts to the regulators from the regulated, money still circulates in the shadows when it flows through the coffers of “Friends” in high places.

Major real estate developers, city contractors, and large corporations often lend financial support to San Francisco city departments, to the tune of millions of dollars every year. But the money doesn’t just flow directly to city agencies, where it’s easily tracked by disclosure laws. Instead, it goes through private nonprofits that sometimes label themselves as “Friends Of…” these departments.

They include Friends of City Planning, Friends of the Library, a foundation formerly known as Friends of the San Francisco Department of Public Health, Friends of SF Environment, and Friends of San Francisco Animal Care and Control.

The Friends pay for programs the departments supposedly cannot cover on their own. Bond money can build a skyscraper, but sometimes not fill it with furniture. Agencies are barred by law from funding an employee mixer or a conference trip, so departments turn to their Friends to fill in the gaps. Adding bells and whistles to city websites, holding lunchtime lectures, hiring a grant writer — or, in the case of the Department of Public Health, bolstering health services for vulnerable populations — these are all examples of what gets funded.

The extra help can clearly be a good thing, but the lack of transparency around who’s giving money raises questions — especially if it’s a business gunning for a major contract or a permit to build a high-rise.

City agencies receive outside funding from a wide variety of sources. Sometimes grants are made by the federal government, or a well-established philanthropic foundation — and according to city law, gifts of $10,000 or higher must be approved by the Board of Supervisors. But in the case of organizations like Friends, which are created specifically to assist city government agencies, the original funders aren’t always identifiable. And the collaboration is frequently much closer, with city staff members serving on Friends boards in a few cases.

Friends board members told the Guardian that their partnership with government helps bolster city agencies in a time of increasing austerity, in service of the public good. But do the special relationships these influential insiders hold with high-ranking city officials come into play when awarding a contract, issuing a permit, making a hiring decision, or determining whether a developer’s request for a rule exemption should be honored? Without more transparency, it’s tough to tell.

City disclosure rules state that any gift to a department must be prominently displayed on that department’s website, along with any financial interest the donor has involving the city. But Friends and other outside funders are under no obligation to share their supporters’ names, much less financial ties, when they distribute grants. Meanwhile, the disclosure rules that are on the books seem to be frequently ignored, misunderstood, or unenforced, our investigation discovered.

How are donors repaid for their support? Consider the controversy earlier this year around Pet Food Express, which won approval in June for another store in the Marina District despite opposition from four locally owned pet stores in the area that fear competing with a large national chain. Pet Food Express won the unlikely support of the city’s Small Business Commissioners, some of whom reversed their 2009 positions opposing the chain’s previous application.

SF Animal Care and Control Director Rebecca Katz personally lobbied the commission to support Pet Food Express, at least partially because the company has donated pet supplies valued at $50,000 to $70,000 per year to the department. That’s a lot of money for a cash-strapped city department, but a pittance compared to the profits of an expanding national chain.

It’s moments of clarity like those, when the public can easily trace the line from donations to political influence, that show why disclosure is so crucial. But those moments are few and far between when trying to trace the funders of private foundations and Friends organizations, where deals often happen in the dark.

 

WHEN DEVELOPERS ARE FRIENDS

At the Merchant Exchange Building in May, a crowd of high-profile real-estate developers mixed and mingled with city planners, commissioners, and even Mayor Ed Lee, wine glasses in hand. Sources told the Guardian that most of the planning staff was present, and not all were happy about having ribbons and name tags affixed to their shirts, as if they were being auctioned off.

With around 500 in attendance, the event was an annual fundraiser hosted by the Friends of San Francisco City Planning, a nonprofit organization that accepts contributions of up to $2,500 per individual to lend a helping hand to the Planning Department. This year’s event was titled “Incubator Startups, New Jobs for the Future,” hinting that the development community shares the mayor’s affinity for new tech startups and the droves of high-salaried IT professionals they’ve attracted to the city.

Some Friends of City Planning board members are major real-estate developers who routinely seek approval for major construction projects. Others are former planning commissioners, or have a background in community advocacy.

Amid widespread concern about displacement, gentrification, and the overall character of San Francisco’s built environment, no city department has greater influence than Planning. An individual’s interpretation of the Planning Code can carry tremendous weight; it’s a series of small decisions that shape a project’s profits and the look and feel of San Francisco’s future. And with cranes dotting the city’s skyline and market-rate construction catering to the wealthy while middle income residents get priced out, the amount of capital flowing through the development sector these days is astonishing.

In this dizzy climate, there might seem to be something askew about affluent developers and land-use attorneys rubbing elbows with city regulators, all eager to pass the hat for the Planning Department. Whiff of impropriety or no, the fundraiser appears to be totally legal.

“We aren’t violating the law — that I know,” Friends of City Planning Chair Dennis Antenore told the Guardian. “We’ve had legal advice on that for years.”

There is close collaboration between Friends of San Francisco City Planning and the Planning Department — a partnership so entrenched that it’s almost as if the nonprofit is an unofficial, private-sector branch of the agency.

“We are certainly thankful and appreciative,” Planning spokesperson Joanna Linsangan told the Guardian. “They’ve helped us for many, many years.” The additional funding is needed, she said, because “there isn’t a lot of wiggle room” in the departmental budget.

Each year, Planning Director John Rahaim submits a wish list to the Friends, outlining projects he wants funding for. This year, he requested $122,000 for a variety of initiatives, including training support to help planners assess proposals for formula retail (read: chain stores). That’s a hot-button issue lately, and one that shows how seemingly small decisions by planners can have big impacts.

When the department’s zoning administrator ruled that Jack Spade, a high-end clothing chain that opened up in the old Adobe Books location on 16th Street, wasn’t considered formula retail and therefore didn’t need a conditional use permit, neither widespread community outrage nor a majority vote by the Board of Appeals could reverse that flawed decision. It was a similar story with the Planning Commission’s Oct. 3 approval of the 555 Fulton mixed use project, where Planning Department support for exempting the grocery store for the area’s formula retail ban made it happen, to the delight of that developer.

Even though the planning director makes specific funding requests each year to the Friends and pitches the projects in person at their meetings — and the Friends publishes a list of the grants it awards to the department online — the Planning Department is not reporting those gifts to the Board of Supervisors.

“I confirm that the Planning Department did not receive any gifts,” Finance and IT Manager Keith DeMartini wrote in official gift reports submitted to the Board of Supervisors for the years 2011-12 and 2012-13. Those reports were sent to the board on Oct. 7 and Oct. 4, respectively, well after the July filing deadline and after the Guardian requested the missing reports.

The Friends typically funds two-thirds of the requests, said board member Alec Bash, totaling around $80,000 a year. In 2012, the Friends awarded a $25,000 grant to make the department’s new online permit-tracking system more user-friendly, making life a lot easier for developers.

When asked what safeguards are in place to prevent undue influence when the director is soliciting funding from a nonprofit partially controlled by developers, Linsangan responded, “those are two very separate things. One does not influence the other.”

She stated repeatedly that planners are not privy to information about individual contributors — but the fundraisers are organized by a board that includes identifiable developers, and anyone who attends can plainly see the donors in attendance. Nevertheless, Linsangan insisted that planners would not be swayed by this special relationship, saying, “That’s simply not the way we do things around here. We do things according to the Planning Code.”

But as the ruling on Jack Spade shows, as well as countless rulings by planners on whether a project is categorically exempt from the California Environmental Quality Act, interpreting the codes can involve considerable discretion.

The public can’t review a list of who wrote checks to the Friends of San Francisco City Planning for the May fundraiser. Since the organization waits a year between collecting the money and disbursing grants, donors stay shielded from required annual disclosures in tax filings.

But Antenore says the system was established with the public interest in mind. “We don’t reveal the contributors, because we don’t want anybody to have increased influence by a donation,” he insisted. Bash echoed this idea, saying the delay was to “allow for some breathing room.”

Unlike some of his fellow board members from the high-end development sector, Antenore has a history of being aligned with neighborhood interests on planning issues, helping author a 1986 ballot measure limiting downtown high-rise development. He emphasized that the developers on the Friends board are balanced out by more civic-minded individuals.

Still, developers who regularly submit permit applications for major construction projects sit on the Friends board. Among them are Larry Nibbi, a partial owner of Nibbi Bros.; Clark Manus, CEO of Heller Manus Architects; and Oz Erikson, CEO of the Emerald Fund development firm.

“We’re not making use of [the funding] in a way that benefits these people,” Antenore said. “I wouldn’t do this if I thought otherwise. I have been careful to maintain the integrity of this organization.” The money is meant to facilitate better planning, he added. “I don’t think there’s any conspiracy,” he said. “We’re not financing anything evil.”

Both the Planning Department and its Friends dismissed the idea that the donations could open the door to favoritism or undue influence. So why isn’t the department reporting gifts it receives from the Friends to the Board of Supervisors, or disclosing them on its website, as required by city law?

According to a 2008 City Attorney memo on reporting gifts to city departments, when an agency receives a gift of $100 or more, it “must report the gift in a public record and on the department’s website. The public disclosure must include the name of the donor(s) and the amount of the gift [and] a statement as to any financial interest the contributor has involving the city.”

John St. Croix, director of the San Francisco Ethics Commission, confirmed that’s the current standard, telling us, “The actual disclosure should be on the website of the department that received the gift.”

Linsangan said records of the gifts are indeed available — listed as “grants” in the department’s Annual Report. But while the 2011-12 report lists grants from sources such as the Metropolitan Transportation Commission and the Environmental Protection Agency, there was no mention of Friends of City Planning.

The memo also says any gift of $10,000 and above must first be approved by a resolution of the Board of Supervisors. But last year, when the Friends provided $25,000 to upgrade the permit-tracking system, it wasn’t sanctioned by a board resolution. Asked why, Linsangan made it clear that she was not aware of any such requirement.

As is common, when it comes to adhering to disclosure laws, confusion abounds. And sometimes, only sometimes, politicos get caught.

 

READING UP ON DISCLOSURE LAWS

When the head of a city agency fails to report gifts totaling $130,000, how much do you think he is fined?

City Librarian Luis Herrera failed to report receiving that amount in gifts and he was fined exactly $600 by the California Fair Political Practices Commission on Sept. 19. Specifically, Herrera had to file a form 700 with the FPPC to state the gifts he received. From 2008-2010, the forms he turned in had the “no reportable interests” box checked.

The money was used in what he calls the City Librarian’s Fund, which is the money he keeps on hand to pay for office parties and giving honorariums to poets and speakers who perform at the library’s branches, money that wasn’t disclosed on the very forms designed for reporting it.

There are two stories of how the fine came about. Longtime library advocate James Chaffee said that it was the result of a complaint he filed with the FPPC in April, and indeed, he sought and obtained many public documents revealing the money trail. San Francisco Public Library spokesperson Michelle Jeffers disagreed, saying that the fine was the result of an ongoing conversation with the FPPC to figure how exactly to file the gifts appropriately.

“The law wasn’t clear around these forms and it wasn’t clear if he had to report them,” she told the Guardian. “For amending the reports you have to pay a $200 fine for every year it was proposed. We keep scrupulous records on every pizza party we have.”

When government officials receive “gift of cash or goods,” they must report them annually in statements of economic interest, known as a Form 700, to the city Controller’s Office. The form is kind of a running tally of who is receiving gifts from whom, a way for the public to track money’s influence in government.

The gifts came from the Friends of the San Francisco Public Library, another nonprofit that bolsters city agency funding. Now Herrera has to list the $130,000 gifts from fiscal years 2008-09 and 2009-10 on his website.

What exactly does that accomplish? As it turns out, not a whole lot.

City Administrative Code 67.29-6 defines the reporting of gifts to city departments, and one of those requirements is to make a statement of “any financial interest the contributor has involving the city.” Now that Herrera lists the Friends of the San Francisco Public Library as donors on the department website, the statement of financial interest by the friends group is this: “none.”

There are myriad donors to the Friends of the SFPL, and the group doesn’t have to state the economic interests of its donors, or even mention who its donors are. The code requires gifts be reported to the controller, and the deputy city controller told us this doesn’t apply to the “friends of” organizations, or any nonprofit foundation arms of city departments.

“If gifts are made to a department, yes, they have to disclose, so people don’t get preferential interest in getting city contracts,” Deputy Controller Monique Zmuda told us. “I know it’s a fine line. The foundations don’t provide us with anything.”

Friends of the SFPL doesn’t provide money just for pizza parties. A breakdown of a funding request from the library to its Friends shows requests up to $750,000 to advertise the library on Muni and in newspapers, funding for permanent exhibits, and the City Librarian’s personal fund. That’s just the money it gives to the library. Other monies are spent directly on activities supporting the library.

As Jeffers pointed out to the Guardian, the money isn’t spent on “trips to Tahiti.” Friends of the SPL do good city works, from a neighborhood photo project in the Bayview branch library to providing books for children. But the question is: Who’s buying that goodwill and why?

The millions of dollars in donations made to the Friends of the SFPL don’t need to be approved by the Board of Supervisors, like gifts to departments do. They’re not checked for conflicts of interest or financial interest by any governmental body. Donors give and the Friends of SFPL spend freely, financial interest or not.

When our research for this story began, no financial statements were available of the Friends of the SFPL website. After a few days of inquiries, the most recent year’s financial statements from 2011-12 were posted to the website.

Ultimately, the San Francisco Public Library is one of the smaller city departments, with an annual budget that hovers around $86 million. The Department of Public Health is a much bigger beast, with a 2011-12 budget of around $1.5 billion.

One of its main foundations, the San Francisco General Hospital Foundation, is also one of the largest nonprofits that supplements city spending. In many ways, it could be described as the model of disclosure for city foundations, although its disclosures are not by law, but by choice.

 

FOUNDATION OF FRIENDS

The Department of Public Health relies on a few entities that fundraise on its behalf: the San Francisco Public Health Foundation, the Friends of Laguna Honda Hospital, and the San Francisco General Hospital Foundation.

“They’re private nonprofit entities that are separate from the department,” CFO Greg Wagner told us. “But their roles are to support the department in its efforts.” He cited examples such as sending its staff to conferences or hosting meetings, “things that we don’t have the budget for or don’t have the staff or resources.”

The lion’s share of the DPH’s gifts are funneled through the SFGHF. Unlike many of the assorted Friends groups or foundations that support city services, the SFGHF extensively reports the sources of its $5 million in donations. The donors include a veritable who’s who of San Francisco: the Giants, Sutter Health, Xerox, Pacific Union, and Kohl’s all donated between $1,000 and $10,000 in the past two years.

But the largest gifts to the SFGHF came from Kaiser Permanente, and its financial interests in the city run deep. Kaiser came into the city’s crosshairs in July, when the Board of Supervisors passed a resolution calling on Kaiser to disclose its pricing model after a sudden, unexplained increase in health care costs for city employees. Kaiser holds a $323 million city contract to provide health coverage, and supervisors took the healthcare giant to task for failing to produce data to back up its rate hikes.

In the meantime, Kaiser has also been a generous donor. It contributed $364,950 toward SFGHF and another $25,000 to SFPHF in fiscal year 2011-12.

The funding from Kaiser and a host of other contributors — which include Chevron, Intel, Genentech, Macy’s, Wells Fargo (another city contractor), and a pharmaceutical company called Vertex — does support needed programs. They include research into the health of marginalized communities, services through Project Homeless Connect, screening for HIV, and immunization shots for travelers.

But because DPH doesn’t count much of this support as “gifts” formally received by the city, it isn’t subject to prior approval by the Board of Supervisors, or posted on the department’s website along with the contributors’ financial interests. Major contributions are disclosed in a report to the Health Commission, something Wagner described as a voluntary gesture in response to commissioners’ requests.

“Most gifts to foundations are donations to a nonprofit and do not come through the city or DPH at all,” he noted.

This distance is maintained on paper despite close collaboration with the department. In the case of Project Homeless Connect, a program that holds a bimonthly event to aid the homeless, it supports programs headquartered in city facilities. Penny Eardley, executive director of SFPHF— which used to be called Friends of San Francisco Public Health — noted that her organization occasionally makes grants or seeks funding in response to department requests. And Deputy Director of Health Colleen Chawla is a foundation board member. It’s almost like these foundations are extensions of the department, except they’re not.

SFPHF also earns revenue as a city contractor. When DPH received a grant from the Centers for Disease Control, it contracted with SFPHF to manage subcontracts with about a dozen community-based organizations.

The web gets even more tangled. The president of SFPHF is Randy Wittorp — who’s also Director of Public Affairs for Kaiser Permanente’s San Francisco Service Area. It’s a similar story with SFGHF, whose board includes several General Hospital administrators, including CEO Susan Currin.

Former Health Commissioner James Illig said people shouldn’t worry, that hospital the staff would never direct foundation funds to pet projects or mishandle funds. They maintain a separation and a firewall,” he said, for example noting, “Sue Currin is not directing funds to her own hospital.”

But he did admit that since SFGHF’s minutes are not public documents, that “raises a few concerns,” arguing the public should be able to inspect financial documents to decide if the foundations are directing funds lawfully to city departments.

Even when the public by law has a right to access financial records of a city department, rooting out corruption can be like pushing a boulder up a San Francisco hill.

 

FROM PATIENTS TO PARTIES

In 2010 and 2011, Laguna Honda Hospital administrators and staff used money from the hospital’s patient gift fund to throw a party. And then they spent it on airfare. And then they gave laser-engraved pedometers to the staff. All told, they spent nearly $350,000 meant for the dying and the infirm, nearly half of the total funds.

The incident was big, messy, and out in the public eye. It was an all-too-rare glimpse into the shady use of public funds by public officials. But when hospital staff members Dr. Derek Kerr and Dr. Maria Rivero blew the whistle on Laguna Honda’s misuse of patient funds in 2010, they were drummed out of their jobs.

Eventually litigation on behalf of the whistleblowers and their complaints of corruption were found to have merit.

Kerr’s vindication came at a meeting of the Health Commission in April 2013. In the packed City Hall meeting room, the public watched as Laguna Honda Executive Director Mivic Hirose read her apology to Kerr and Rivero aloud, even announcing a plaque in Kerr’s honor.

“The hospital will install the plaque in the South 3 Hospice,” she read, stiltedly, from a written statement, surrounded by microphones at the podium. “The plaque will say: In recognition of Derek Kerr MD of his contributions to the Laguna Honda’s hospice and palliative care program 1989-2010.”

Kerr received a settlement of $750,000 and something more important: His good name cleared.

But that conflict of interest was rooted out only after years of litigation that revealed the financial abuse through legal discovery of the department’s documents — documents that should’ve been public in the first place. ABC 7’s I-Team broke the story and did much of the reporting at the time, otherwise the entire affair may have been swept under the rug.

The misuse of funds was only brought to light with the revelation of public documents — revelations not possible with most Friends groups. The Laguna Honda Hospital Foundation has also had financial dealings with potential conflicts and a lack of transparency.

The now-defunct LHHF’s board chair, former City Attorney Louise Renne, made an interesting choice for her vice chair after she formed the nonprofit in 2003. Derek Parker was vice chair of the LHHF while simultaneously heading architecture firm Anshen-Allen, with a $585 million city contract to rebuild the hospital.

So he was not only rebuilding Laguna Honda under city contract, but soliciting and spending donations meant to supplement his project. Renne wrote to the Health Commission in December 2011 that LHHF’s purpose was to manage over $15 million in donations meant to furnish the hospital with beds, chairs, and other necessities. Eventually, then-Mayor Willie Brown found funding for the hospital, reducing the foundation’s role.

In a phone interview with the Guardian, Renne said the goals of the LHHF were only ever to furnish the newly christened hospital. “Our purpose was to fill the void, if you will, for what the city and its services could not do,” she said.

But in her letter, Renne advocated for LHHF to take an active role in fundraising for the hospital for years to come. “Today, the members of the Board of Directors of the Foundation continue to assist the hospital in various phases of its new projects and operations with projects approved by the City and/or the hospital administration,” she wrote to the Health Commission.

And Parker would have potentially managed millions of dollars flowing through donations for countless other hospital projects, while heading an architectural firm with contracts to build in San Francisco. We were unable to reach Parker for comment.

“I never saw Derek use his position as an architect or position for any political gain, I never saw it,” Renne told us. But no one else would see it either, because organizations like the now closed Laguna Honda Hospital Foundation operate without public oversight.

The Health Commission itself even noted this in its March 2012 meeting, the minutes describing then-commissioner James Illig as critiquing the foundation for not being open about its source of funding.

“Commissioner Illig thanks Ms. Renne and Mr. Parker for coming to the Commission,” the minutes read. “Because (LHHF) is a project of Community Initiatives, a fiscal sponsor for nonprofits, it is not possible to find basic financial information about the Foundation or its activities.”

Divided interests on hospital board

Due to a quirk of her foundation being under the “umbrella” of a separate entity, Community Initiatives, Illig was never able to even get the LHHF’s IRS forms, he told us. “We tried to get information and reports, and the Community Initiatives [Form] 990 was giant,” Illig said. “It didn’t separate anything out.”

Illig told us that it made sense to have Parker on the board because he is monied and well connected, making it easier to solicit donations. But insiders close to the board told us that Parker’s position may have made it easier to swing getting other contracts for his firm.

Parker got another city contract building the UCSF Benioff Children’s Hospital at Mission Bay, slated to open in 2015. No doubt his firm got the job partly due to his reputation as pioneering architecture that leads to healthy patient outcomes — but then again, the board he served on also approved donations to research at UCSF.

Laguna Honda Hospital Foundation may now be defunct, but it serves to illustrate the lack of controls and oversight of the foundations beyond even gift disclosure.

 

OFF THE BOOKS

It might be characterized as a web of influence, cronyism, or just the way business is done. But is there something improper about all of this?

Private funding often represents a needed boost that allows for important work to take place beyond what could happen under ordinary budgeting. At the same time, it smacks of privatization. While departments and funders point to lean times in the public sector to justify the need for this help, the funding continues to flow whether it’s a good year or a bad year for city government. And at the end of the day, the most glaring issue of all seems to be the lack of transparency.

Are city departments ever tempted to bend the rules to lend a little help to their Friends? As long as the funding is in the dark, the public has no way of knowing.

Ethics chief St. Croix told us his office lacks the resources to visit every city website and check up on whether departments are following the disclosure rules. “If someone brought it to my attention that a department received a gift and didn’t post it [on the website],” he said, “we would look into it.”

But if the watchdogs need watchdogs, citizens who can’t even review documents that should be publicly available, then these quasi-governmental functions and the people who fund them will remain in the shadows.

Is Art Torres helping PG&E, helping his son’s political career, or both?

As I’ve been reporting on how CleanPowerSF is being blocked by Mayor Ed Lee and his political appointees on the San Francisco Public Utilities Commission, one piece of the puzzle that I couldn’t quite figure out was why SFPUC President Art Torres took the position he did, offering little public explanation for his stance.

“His opposition to the rate vote was strange because he didn’t give clear reasons,” Eric Brooks, who has been led the grassroots campaign in support of CleanPowerSF, told us. Torres also hasn’t returned Guardian calls on the issue, and he refused a formal request from Sup. John Avalos to explain his position.

As a former state senator and longtime former chair of the California Democratic Party, Torres certainly has connections to Pacific Gas & Electric and the array of politicians that support it, include Willie Brown. But that just didn’t seem like enough for a senior statesman with a decent environmental record to sabotage San Francisco’s only plan for building renewable energy projects.

But some of my political sources have clued me into another possible motive, and it seems to make sense. Art Torres’ son is Joaquin Torres, who works in the Mayor’s Office and who Lee in February appointed to the Housing Commission, where Torres now serves as president.

And here’s the kicker: those sources also say that Joaquin Torres has already started running for the District 9 seat on the Board of Supervisors, which is now held by Sup. David Campos, who is running for Tom Ammiano’s seat in the California Assembly. And if Campos wins that race next year, Mayor Lee will get to fill it, possibly naming Torres to one of the most progressive seats in the city.

So dad gets to score political points with some powerful friends, and help launch his son’s political career in the process. These motives are beginning to add up.

Joaquin Torres is now deputy director of the San Francisco Office of Economic and Workforce Development, “where he leads Mayor Lee’s Invest In Neighborhoods Initiative to leverage City resources across city departments to maximize positive economic and social impact in low-moderate income neighborhoods and throughout San Francisco’s commercial corridors,” the Mayor’s Office wrote in February when Torres got appointed to the Housing Commission.

Sounds like the perfect job for someone being groomed for the Board of Supervisors, where he could have a serious impact on this city’s political dynamic, tipping policies in the neoliberal to moderate direction of expanding corporate welfare programs and speeding up gentrification.

Neither Torres has returned our calls, but I’ll update this post when and if they do. And while this is clearly just political speculation and conjecture, I have a feeling that I’m onto something here. So remember where you read it first.  

Bay Bridge turns Brown

The California Senate gave its blessing to the rename the western span of the Bay Bridge after former San Francisco Mayor Willie Brown on Sept. 12, blatantly disregarding its own rules and strong local opposition to the proposal.

Since ACR 65 is a nonbinding resolution, Gov. Jerry Brown cannot veto it even though he went on record earlier this week saying the 77-year-old bridge should keep the same name it’s always had.

San Francisco Sens. Mark Leno and Leland Yee both voted in favor of the resolution.

As the Senate gave final approval to the measure, attorneys G. Whitney Leigh and Lee Hepner filed a complaint seeking injunctive relief to overturn the resolution on behalf of their client, good government advocate Bob Planthold.

At a press conference, Planthold said the lawsuit “has nothing to do with Willie,” but rather sought to remedy what he perceived as state lawmakers ignoring their own rules, including reserving such honors for the deceased, a state of affairs he characterized as “Orwellian.”

Leigh questioned why Sacramento legislators were in such a rush to rename part of the Bay Bridge when construction of the eastern span had only just been completed, following long delays and overruns partly caused by Brown when he was mayor.

“There is a shadiness and irregularity to this procedure,” Leigh said.

The suit alleges “arbitrary suspension and/or violation of legislative rules and policies” to fast track the legislation. Specifically, Hepner said, lawmakers ignored an established timeline for introducing new proposals, instead allowing ACR 65 to be submitted four months after the formal deadline.

Formal Assembly criteria states that clear community consensus must be in place when a major piece of public infrastructure is renamed. Yet in the case of the Willie L. Brown Jr. Bridge, no such consensus exists.

Leigh is the former law partner of Matt Gonzalez, a former president of the San Francisco Board of Supervisors, who joined former board presidents Quentin Kopp and Aaron Peskin to formally call on Senate pro Tem Darrell Steinberg to stop the resolution from going forward.

On Aug. 29, the trio fired off an open letter to Steinberg in an attempt to halt the proposal from going any further, claiming “there exists significant concern in our community that naming the Bay Bridge for him is not appropriate.”

Peskin had a more colorful take on Brown and bridge when he spoke to the Guardian: “I think they should name the old eastern span, that they’re demolishing, after him. You know why? Because it’s old and crooked and a danger to society.”

Challenge Mayor Lee and his lies

EDITORIAL In the long history of San Francisco political corruption caused by Pacific Gas & Electric’s willingness to do and spend whatever it takes to hold onto the energy monopoly that it illegally obtained generations ago, in violation of the federal Raker Act, there have been countless ugly and shameful episodes, many of them chronicled in the pages of the Bay Guardian.

Mayor Ed Lee’s misleading Sept. 10 testimony to the Board of Supervisors, where he deliberately distorted CleanPowerSF and defended the dubious actions of his appointees to kill the program, ranks right up there with some of the worst episodes (see “Power struggle,” page 12). If there were any doubts about Lee’s lack of political integrity and independence, about his unwillingness stand up to his corporate benefactors on the behalf of the people he was elected to serve, this appalling performance should settle them.

It was bad enough when PG&E used money from San Francisco ratepayers to bury public power advocates under an avalanche of lies, fear-mongering, and the testimony of paid political allies every election when its monopoly was being challenged, making it virtually impossible to have an honest conversation about the city’s energy and environmental needs.

But now that advocates for consumer choice and renewable energy have spent more than a decade developing a program that doesn’t require a popular vote, is competitive with PG&E’s rates, would create city-owned green energy projects serving residents for generations to come, and which was approved by a veto-proof majority on the Board of Supervisors, Mayor Lee has stooped to new lows in a desperate and transparent ploy to stop it.

Once again, as he did during his rash decision to remove Sheriff Ross Mirkarimi from office before even investigating his most serious official misconduct allegations, Mayor Lee has blithely created what Sen. Mark Leno calls a “Charter crisis.” Then, it was over the question of when one elected official should remove another; now, it is whether a trio of mayoral appointees can usurp the authority of the elected Board of Supervisors, the top policymaking body under the City Charter.

Relying on tortured logic and Clinton-esque legalese backflips doesn’t justify the SFPUC commissioners refusal to do their jobs — and it would be deemed official misconduct by a less corrupt mayor. But this mayor sees his job as simply carrying water for the people who put him there, whether that be Willie Brown and his longtime client PG&E, or venture capital Ron Conway and the companies that Lee is heaping with unprecedented tax breaks (see “Corporate welfare boom,” page 14). Please, isn’t there someone out there willing to challenge this corruption and run for mayor? This city, and the future generations living in the warming world we’re creating, deserve better.

Additionally, he said, the Senate Committee on Transportation and Housing was technically barred from meeting between Sept. 3 and 13 – a rule likely meant to keep lawmakers focused on more pressing issues, like approving 400+ bills before a Sept. 13 deadline – but nevertheless, ACR 65 passed out of that committee on Sept. 9 on an 8-1 vote.

Planthold previously served on the city’s Sunshine Ordinance Task Force and was previously an officer on the San Francisco Ethics Commission. Leigh is the former law partner of Matt Gonzalez, a former president of the San Francisco Board of Supervisors who joined two other former board presidents to formally call on Senate pro Tem Darrell Steinberg to stop the resolution from going forward.

Despite Gov. Brown’s opposition to renaming the Bay Bridge, it remains unclear exactly what he’ll do about it now that it has formally passed. In response to a query about whether he would take steps to halt implementation, spokesperson Evan Westrup responded in an email: “Got your message. Don’t expect we’ll be providing further comment today.”

Proposal to rename Bay Bridge draws controversy

The proposal to rename the western span of the Bay Bridge after former San Francisco Mayor Willie Brown is generating more controversy as it hurtles through the approval process in Sacramento, where lawmakers are staring down a Sept. 13 deadline before the legislative session ends.

Gov. Jerry Brown has expressed opposition to the idea, and the proposed name change prompted yet another scathing editorial from the San Francisco Chronicle. Former Mayor Brown, who also served as Assembly Speaker, publishes a weekly column in the Chronicle.

Chronicle columnists Matier and Ross reported Sept. 10 that Gov. Brown had met with Alice Huffman, a key supporter of the proposal and president of the California NAACP, about the proposed name change.

The partial renaming of the 77-year-old Bay Bridge has seen very little opposition in the state legislature, and backing from the NAACP might be a key reason why there has been such broad support from lawmakers. As it happens, Huffman has long been described as a friend of Willie Brown’s – she briefly worked for him when he was Assembly Speaker and later served as a political advisor, according to Los Angeles Times coverage.

Assembly Member Tom Ammiano opted to stay out of the fray and abstained from voting, a decision his spokesperson Carlos Alcalá explained by saying, “he’s hesitant to vote against it, because of course Willie Brown was a very important figure” in the California Legislature.

At the same time, Alcalá said Ammiano couldn’t support renaming the bridge, because “it has significant opposition,” and “he thought it was inappropriate to name it after a living person.”

Forget the Willie Brown Bay Bridge

EDITORIAL As the California Legislature prepares to wrap up before fall recess, a resolution is working its way through the approval process to rename the western span of the Bay Bridge the “Willie L. Brown Jr. Bridge.”

Brown, who formerly served as mayor of San Francisco and speaker of the California Assembly, is known for boasting about his hobnobbing with the rich and famous in his San Francisco Chronicle column, “Willie’s World.” But to longtime progressive San Franciscans who spent decades trying to stem the tide of gentrification, he was the powerful figure that rolled out the welcome mat for high-end developers and corporate interests, whose interests in San Francisco revolved around profit alone.

As mayor, Brown presided over land-use policies that resulted in high-end developments at a time when evictions were rampant, a trend that rings familiar in today’s tech-saturated San Francisco. Once, when pressed on the idea that his approach was making the city increasingly unaffordable, Brown’s famous retort was: “If you don’t make $50,000 a year in San Francisco, then you shouldn’t live here.”

It’s not just Brown’s insensitivity to struggling tenants, deep ties to corporate interests and high-end real-estate developers, or continued behind-the-scenes influence in San Francisco politics that cause us to squirm when we think about the San Francisco-Oakland Bay Bridge bearing this politician’s name. There’s also the key question of whether Bay Area residents actually want to see this happen — and, given Brown’s historic role as a divisive figure, the idea that there is universal support for such an idea is laughable.

A legislative analysis presented to the Assembly Committee on Transportation a few weeks ago noted that lawmakers actually came up with ground rules for big decisions like whether a bridge ought to be named after someone, to “promote fairness.” The rules stipulate that such a proposal “must reflect a community consensus” — and guess what? Even Brown’s editors over at the Chronicle issued a June editorial opposing the idea.

Not only that, but proposals like this are only supposed to come from representatives of the district where the thing being renamed is located — yet this scheme came from Assemblymember Isadore Hall, a Democrat from Compton. But despite clear failure to adhere to these basic rules, only a single committee member voted against naming the bridge after Brown.

Interestingly enough, the bill even includes a request for Caltrans to determine the cost of posting signs commemorating Brown, which would evidently be funded by donations from unspecified private sources.

If the San Francisco-Oakland Bay Bridge is going to be named after anyone, we agree that the honor should be reserved for beloved 19th-century San Francisco eccentric Joshua Abraham Norton, the Scotsman who proclaimed himself Emperor of the United States in 1859 and printed his own currency.

So far, a Change.org petition calling on Gov. Jerry Brown to name it the Emperor Norton Bay Bridge has garnered 1,800 signatures. “He was a champion of racial and religious unity, an advocate for women’s suffrage [and] a defender of the people,” the petition notes. That sounds more like something motorists can be proud of when they drive back and forth across the bay.

 

Fizzling energy

A plan for a municipal power program that would offer 100 percent green energy to San Francisco customers was stalled on Aug. 13, prompting Sup. John Avalos to explore what legal options might be available to bring the program to fruition without further delay.

Prior to that San Francisco Public Utilities Commission hearing, supporters of CleanPowerSF rallied on the steps of City Hall, urging Mayor Ed Lee and members of the commission to approve a not-to-exceed rate, a technical hurdle that must be cleared before the program can advance. SFPUC staff cannot formalize a contract for purchasing power on the open market until that maximum rate has been formally established, so as long as it goes unapproved, CleanPowerSF lingers in limbo.

“We call on the Mayor’s Office to stop impeding progress with heavy-handed politics,” said Shawn Marshall, executive director of Local Energy Aggregation Network (LEAN) — a group that assists with clean-energy municipal power programs. “And we ask the San Francisco Public Utilities Commission to stay focused on its job of implementing a program that was approved by the San Francisco Board of Supervisors last September. That’s almost a year ago, folks.”

But after more than two hours of public comment in which dozens of advocates voiced support for moving ahead with the program, SFPUC commissioners voted down a motion to approve the rate, leaving CleanPowerSF in limbo with no clear path forward.

 

COMMISSIONER CONCERNS

Commissioners Francesca Vietor and Anson Moran were the only ones on the commission to favor the rate approval, while Ann Moller Caen, Vince Courtney, and President Art Torres shot it down.

“I feel like today is a historic moment for the SFPUC as well as the city of San Francisco,” Vietor said as she introduced the motion at the beginning of the meeting, “to become a leader in combating climate change.”

Rather than focus on the question of whether or not to establish a top rate of 11.5 cents per kilowatt-hour (a reduced price from an earlier proposal that sparked an outcry from critics because of the sticker shock), Torres and Caen criticized CleanPowerSF before casting “no” votes.

Caen said she’d “always had problems with the opt-out situation,” referring to a system that will automatically enroll utility customers into the program, while Torres criticized the project for changing shape since its inception, saying, “at the end of the day, this is not what San Franciscans had anticipated.”

But after straying well beyond the scope of a discussion about the not-to-exceed rate, commissioners who shot down CleanPowerSF didn’t provide SFPUC staff with any hints on how to allay their concerns. Some might interpret the hearing outcome as a death knell for CleanPowerSF, but Avalos has taken up the cause of pushing for implementation.

Unable to attend the hearing in person, Avalos sent legislative aide Jeremy Pollock to convey his concerns. “We all understand the politics of the situation,” his statement noted. “The Board of Supervisors and every major environmental group in the City support this program. The Mayor, PG&E, and its union oppose it. I know you are feeling a lot of pressure from both sides. But we cannot afford further political gamesmanship to cause additional delays in an attempt to kill this program.”

The effort to implement CleanPowerSF is mired in politics. For Pacific Gas & Electric Co., Northern California’s largest utility, the enterprise represents an encroachment into prime service territory and a threat to the power company’s monopoly.

PG&E has long been highly influential at San Francisco City Hall. It has funded many political campaigns and curried favor with powerful figures (former San Francisco Mayor Willie Brown, known to be a frequent dining companion of the mayor, has been richly rewarded for his consulting services, for instance). Mayor Ed Lee opposes the program, and holds the authority to appoint commissioners to the SFPUC.

 

CLASH OF CITY BODIES

The City Charter gives the SFPUC the responsibility of establishing fair and sufficient rates for the city’s utility operations. But Avalos charged that “any further delay will essentially show that we are in a constitutional crisis caused by a city department failing to carry out a policy approved by a veto-proof supermajority of the Board of Supervisors.”

The supervisor added that if the rate failed to win approval at the hearing, he would call upon the City Attorney to explore legal options “to resolve this type of stalemate—including the possibility of drafting a Charter Amendment. CleanPowerSF is too important and the threat of climate change is too significant to allow this program to die on the vine. It is time for leadership.”

Pollock said on Aug. 15 that Avalos was still awaiting a response from City Attorney Dennis Herrera’s office.

Meanwhile, activists who’ve attended countless meetings with SFPUC staff to move the program forward expressed frustration in the aftermath of the vote. “Things are in this holding pattern, and the dissenting commissioners did not provide a way forward,” noted Jed Holtzman, an advocate with climate group 350 Bay Area. “They just kind of said, ‘no.'”

The weekend before the hearing, mailers paid for by International Brotherhood of Electrical Workers Local 1245, a union representing PG&E employees, blanketed Noe Valley residences with fliers. Depicting seashells besmirched with oil, the mailers seized on the involvement of Shell Energy North America, an oil giant with a contract pending with the SFPUC to administer power purchases for the first four and a half years of the program.

Shell’s involvement presents something of a challenge for advocates, who have long advocated for a program that would be run entirely by the SFPUC with a centerpiece of renewable power generation facilities that could double as a source of local job creation.

The initial program phase looked quite different: Shell would purchase green power on the open market, making CleanPowerSF significantly more expensive than PG&E. To address that concern and lower rates, SFPUC staff recently allowed the use of Renewable Energy Credits (RECs), more affordable units accounting for green power produced somewhere in California as opposed to electricity coming straight over the power lines.

Despite the drawbacks of a more watered down start to the program and the involvement of a notorious fossil fuel company, progressives and major environmental organizations strongly advocated for moving forward with the Shell contract to give the SFPUC a shot at positioning itself financially to float revenue bonds for build-outs of a local green energy infrastructure.

“The plan is to completely replace this with the build-out,” noted John Rizzo, who sits on the executive committee of the San Francisco Bay Chapter of the Sierra Club.

 

BUILDING LOCAL PROJECTS

A 134-page report prepared by Local Power Inc. described in careful detail how the city could use wind, solar, geothermal, energy efficiency, and other measures for a viable program. While SFPUC representatives have indicated that some of those recommendations will still be implemented, the agency is no longer working with Local Power.

“Our draft model was 1,500 jobs per year,” Paul Fenn, founder and president of Local Power, wrote in an email to the Guardian. “But earlier runs show as many as twice that many jobs, and we projected the higher end for the final model.” In the end, though, “SFPUC declined to continue with completion of this work, so we are in limbo — apparently an organization without allies,” Fenn added. Asked about this, Kim Malcom, the SFPUC’s director of CleanPowerSF, told the Guardian that Fenn’s analysis was based on the assumption that the agency would issue bonds totaling $1 billion. “We have no confidence that we could issue a billion dollars worth of bonds in the first few years of the program,” she said, noting that the highest the agency expected to go was closer to $200 million. And at this point, it remains to be seen whether CleanPowerSF will move ahead at all. “One of the difficulties we face is that we can’t move forward without a rate,” SFPUC spokesperson Charles Sheehan noted. “In terms of launching and implementing, we can’t do that until we have a rate structure,” and now that the utility board has blocked that from happening, there is no clear path forward. Still, activists who are serious about CleanPowerSF believe it’s key for positioning San Francisco as a leader in the fight against climate change. “CleanPowerSF is a crucial step for achieving California’s 2020 greenhouse gas goals,” Bill Reilly, chairman emeritus of the World Wildlife Fund and a former EPA administrator, wrote in a letter to Lee. “It’s also an essential model &ldots; as cities and communities are compelled to address the problems fueled by climate change.”

Backward on climate

After a hearing lasting several hours on Tue/13, members of the San Francisco Public Utilities Commission voted down a motion to approve electricity rates for CleanPowerSF, a municipal energy program designed to offer a 100 percent green energy mix to San Francisco customers.

The approval of that “not-to-exceed” rate, set at 11.5 cents per kilowatt-hour, would have cleared the path to set CleanPowerSF in motion after almost a decade of politically charged debates and setbacks.

“I feel like today is a historic moment for the SFPUC as well as the city of San Francisco,” commissioner Francesca Vietor said as she introduced her motion to approve the rate. “Even though I understand this is only a vote to approve the not-to-exceed rate,” she added, it was a critical first step toward a long-term vision in which “we will also be able to create a new generation of green collar workers and build our own renewable power system.”

In the end, Vietor and Commissioner Anson Moran were the only ones to favor the rate approval, while Ann Moller Caen, Vince Courtney and President Art Torres shot it down. So once again, CleanPowerSF has been kicked back in limbo.

“This is not just about rates today,” Torres said. “If we approve these rates, that would authorize the General Manager [of the SFPUC] to authorize a contract with Shell.”  

Oil giant Shell Energy North America was tapped by the SFPUC to purchase green energy on the open market during the first phase of the program. Although Shell is a fossil fuel company with a disgraceful human rights track record, progressives and environmentalists stand behind a speedy approval of that contract, because they say it is a crucial first step toward realizing the ultimate project vision of constructing city-owned and operated renewable energy facilities while creating local green jobs.

“The deal is that you cannot do that until you move forward, and launch the program,” said Shawn Marshall, executive director of LEAN – a group that assists with clean-energy municipal power programs – speaking at a rally just before the hearing. “You have to live to go local. We call on the mayor’s office to stop impeding progress with heavy-handed politics and we ask the San Francisco Public Utilities Commission to stay focused on its job of implementing a program that was approved by the San Francisco Board of Supervisors last September.”

Rather than focusing on the question of whether or not to approve the rate, Torres and Caen voiced generally negative sentiments about the CleanPowerSF endeavor before casting “no” votes on the rate approval. Caen said she’d “always had problems with the opt-out situation,” referring to a system of automatic enrollment in the program, and Torres criticized the project for having changed shape, saying, “at the end of the day, this is not what San Franciscans had anticipated.”

The bid to establish CleanPowerSF is mired in charged politics. Because the program threatens Pacific Gas & Electric Co.’s monopoly in San Francisco, the utility giant is prepared to shell out whatever it takes to stop the forward momentum. PG&E is deeply influential in San Francisco City Hall, having richly rewarded former San Francisco Mayor Willie Brown, known to be a frequent dining companion of Mayor Ed Lee, for his consulting services, for instance. Lee opposes the program, and the mayor appoints the SFPUC commissioners.

Torres, the commission president, bristled at suggestions from the public that he was merely carrying the mayor’s water, saying, “I do my own homework, and I make up my own mind.”

But Sup. John Avalos has made up his own mind too, and he sent legislative aide Jeremy Pollock to convey the message to the SFPUC that enough is enough. Avalos plans to go to the City Attorney to find out what can be done about the relentless foot-dragging of a commission that just won’t approve a fair rate for a program that was approved by the Board of Supervisors last fall.

During the public comment session of the hearing, Pollock read Avalos’ statement, which characterized the commission’s refusal to approve the rate as a “constitutional crisis” with regard to the body’s responsibilities.

“Any further delay will essentially show that we are in a constitutional crisis caused by a city department failing to carry out a policy approved by a veto-proof supermajority of the Board of Supervisors,” Avalos’ statement noted. “The Board stands ready to approve these rates, but nothing more can happen until you take action. The City Charter is silent on the possibility of the Public Utilities Commission failing to act on a proposed utility rate. Therefore if there is further delay, I feel I have no choice but to request that the City Attorney explore our options to resolve this type of stalemate—including the possibility of drafting a Charter Amendment. CleanPowerSF is too important and the threat of climate change is too significant to allow this program to die on the vine. It is time for leadership. And this vote will be long remembered for the action you take today.”

But instead of just approving that rate – which is lower, by the way, than originally proposed – the commissioners just seized the opportunity to halt the program from moving forward, since CleanPowerSF cannot advance without a contract, and the contract cannot be signed until a rate has been formally approved.

“It seems as if they are essentially refusing to establish a fair rate, so we’re going to ask the city attorney, you know, what’s the recourse if the PUC is failing to carry out their duties?” Pollock noted.

Just before the votes were cast, Vietor, who had urged her colleagues to go forward and approve the rate at the outset of the meeting, was asked to re-state her motion. She returned to the bright and optimistic prepared statement she’d read at the beginning, only this time with a note of frustration because it was clear that the votes weren’t there. “Today is a historic moment for the San Francisco public utility commission,” she read out loud, “to become a leader in combating climate change.”

Petition to name Bay Bridge after Emperor Norton gains 1,000 signatures

San Francisco freelance writer John Lumea disagrees with California state legislators who want to name the western span of the Bay Bridge after former San Francisco Mayor Willie Brown.

Nothing personal against Brown, says Lumea. He just believes that honor belongs instead to 19th century San Francisco eccentric Joshua Abraham Norton (1819-1880), the Scotsman who proclaimed himself Emperor of the United States in 1859 and printed his own currency.

Lumea has drafted and launched a Change.org petition asking the California Legislature to rename the iconic thoroughfare “The Emperor Norton Bay Bridge.” The petition cleared its initial goal of 1,000 signatures on Aug. 12. The Bay Bridge, the petition argues, fulfills Emperor Norton’s “140-year-old vision” of a bridge from San Francisco to Oakland “that has shaped the lives of generations.”

In 1872 Emperor Norton famously proclaimed the need for a suspension bridge between San Francisco, Goat Island (now Yerba Buena), and Oakland. While the Bay Bridge matches the literal proclamation, it also matches Emperor Norton’s social vision for the area, according to Lumea. 

“Emperor Norton was an early visionary of a regional economy,” said Lumea, “and a herald of the whole idea of a Bay Area as a region that shares ideas and relationships beyond economics.” A harbinger of Bay Area progressivism, Emperor Norton also used his local notoriety to advocate on behalf of women’s suffrage and the rights of marginalized populations. 

Past attempts to commemorate Emperor Norton’s special relationship to the Bay Bridge never got off the ground. In 2004, former San Francisco Supervisor Aaron Peskin introduced a resolution to name the entire Bay Bridge after Emperor Norton, but the Board of Supervisors passed a modified version to dedicate just the new additions to the bridge. To date, Oakland and Alameda haven’t obliged.

This June, California State Assembly members had a completely different public figure in mind for the bridge’s name, and introduced a resolution to name the western span of the Bay Bridge after the former Assembly Speaker and San Francisco Mayor Willie Brown. In answer to that proposal, an online petition surfaced in July calling for state legislators to name that span of the Bay Bridge after Emperor Norton instead.

Less than two weeks ago, Lumea’s petition took things a step further, calling on the Legislature and the Governor to name the entire bridge after Emperor Norton.

“As for Willie Brown,” said Lumea, “surely any number of buildings in California could be used for his honor.”

When setting up an interview with Jello Biafra, I got this light-hearted warning: “There is no such thing as a short interview with Jello.” It’s true, the legendary punk showman/spoken word enthusiast is full of political ideas, historical references, and elder-punk-dude tales. How can he be expected to keep it brief?

Below, we spend an intense half hour discussing the media, corruption, spoken word, Jello Biafra and the Guantanamo School of Medicine, Jello Biafra and the New Orleans Raunch and Soul All-Stars, and the future of underground rock’n’roll. Where do you gather your news? What are your sources for political commentary in your songs?

Jello Biafra Why, the Bay Guardian, of course! Where would a local voter be without your fine rag? I just hope the new ownership and staff goes pedal to the metal to keep up the standard of muckraking and ethics. There’s so much corruption to dig up in this area.

I think the real renaissance was before the Weekly was sold to New Times/VVM, when the Guardian and the Weekly were both muckraking papers concentrating on local issues and were trying to out-scoop each other. That’s what I’d like to see continue and come back.

But basically I’d read a lot of periodicals. Locally, we have you folks, among others. And then you know Nation, Progressive, Mother Jones, interesting things people send me in the mail, digitally or otherwise, talking to people, putting two and two together — trying to write songs about stuff that no one else has! Or at least not in the same way.

SFBG Why is that? Why choose to write songs about something no one else has?

JB It’s just filling in the gaps with what’s interesting. I’m proud that no two of my music albums sound alike. Not even the Lard albums sound alike. From Dead Kennedys onward my mission as the main lyricist and composer of the damn tunes, I kind of stick to my punk core — whether I intend to or not, it’s just who and what I am — and but kind of widen the base of the pyramid to what you can do with that energy.

SFBG What are some the topics you focused on when writing White People and the Damage Done?

JB I guess it was a little more focused as a semi-concept album, than anything since Frankenchrist. It’s basically about grand theft austerity, and how unnecessary it is, what a scam it is. People have asked me when we go to play different cities or countries, what I think is the biggest problem in the world today and they expect me to say something like “climate change” which I prefer to call “climate collapse” because that’s what it is, or inequality, or war, or whatever, and I say you know, there’s a worse one, it’s corruption. Because that is what’s blocking anything constructive being done about all the other problems. There’s a thread through White People and the Damage Done about that. 

The title track is not so much about race specifically, but about this attitude of the higher ups in the United States, the EU, and others, is that other countries, especially ones run by people of color, where we call them “Third World” or whatever, are somehow unfit to govern themselves and need us to pull the strings, plant the puppets, and tell everyone what to do. And it’s often for the purposes of looting their resources and exploiting their people. And what kind of unintended consequences that can have.

For example, we talk about why we need more democracy in Iran, and we don’t have the big bad Soviet Empire to freak out everyone anymore so we have Iran and North Korea instead. Wait a minute, you want democracy in the Middle East? Well Iran was a democracy in the early 1950s, guess who decided to overthrow the democratically-elected leader Mohammad Mosaddegh, and put the most hated person in the country, the Shah, back into power? But he was our policeman for the gulf basically, and he got overthrown anyway. And now it’s a theocratic regime. Where would be today if we had just left that region alone in the 1950s?

Same for Afghanistan. I nearly went through the roof when I found out about an interview with Jimmy Carter’s old national security advisor, Zbigniew Brzezinski’s, whose daughter is on one of the morning cartoon pundit shows, bragged on an interview with French media about what a great thing we did by arming, training, and financing the guerrillas in Afghanistan before the Soviet Union invaded, and how we cracked apart the evil empire, hooray for us, we win.

But look what we created for crying out loud. We were even helping back a young hothead with a trust fund named Osama Bin Laden. And then once the Soviets were out, we didn’t lift a finger to help rebuild the country, let alone take back the guns and rocket-launchers. And now look where we are. That’s another example of white people and the damage done.

[Pause] hold on my juice machine, now I have to turn it off, it’s bouncing all over the counter.

SFBG What kind of juice are you making?

JB Oh, just a mixture of stuff. Spinach, apples, other things.

SFBG Can you tell me about forming Guantanamo School of Medicine?

JB Here we go again. I wanted to have another band ever since Dead Kennedys, it just never quite happened. Either people weren’t available, or I was off doing spoken word or other adventures, but of course I never stopped making albums, there was Lard, two with the Melvins, one with DOA, Mojo Nixon, NoMeansNo.

I kept the music out there, I just didn’t have a performing vehicle. And then when I was down at the Warfield seeing the Stooges on Iggy’s 60th birthday, it occurred to me, “oh shit, I turn 50 next year. I better do something or I may never get another chance.” If it’s half as good as the Stooges, I’ll declare victory.

SFBG Do you have any other projects coming up?

JB I started getting back into spoken word. I did a tour in Australia after the band’s tour was done. And at some point, something that will probably see the light of day: some of the New Orleans guys from Cowboy Mouse and Dash Rip Rock dared me to come down there during the jazz fest a few years ago and do a whole set of New Orleans soul and rhythm and blues songs, which I did with some badly needed garage rock added in and we got Mojo Nixon’s keyboard wizard with all the Jerry Lee Lewis moves, and quite the cacophonous horn section, as well as [Cowboy Mouth’s] Fred LeBlanc, and [Dash Rip Rock’s] Bill Davis.

The multitrack recording was a trainwreck, but then Ben Mumphrey who works with Frank Black and the Pixies and many others, called me up and said he could rescue this recording. Slowly but surely he has been rescuing it. So Jello Biafra and the New Orleans Raunch and Soul All-Stars will see the light of day somehow. We haven’t been able to pull it together to play a show though.

SFBG I was wondering your opinion of this new, kind of second tech bubble taking over in areas like the Mission?

JB Again, I refer you to one of my songs. It came out on the EP of the rest of the recording session when we recorded The Audacity of Hype with Billy Gould. The song is called “Dot Com Monte Carlo.” And sure enough there was a little mini firestorm on the Internet of course. A lot of people writing in were too chicken-shit to sign their own names, but they said ‘oh that’s such an old topic, it doesn’t matter anymore.’

Well I had this funny feeling we weren’t done with the Dot Com Holocaust. Sure enough, now it’s more aggressive and obnoxious than ever. Dot Com Monte Carlo — that’s kind of what Willie Brown’s puppets are trying to turn this city into, yet again.

It has been really sad for me to see so many cool people and artists and service-workers and people of color just bull-dozed out of this town to make room for more mini little yuppies who treat San Francisco as a suburb of Silly-clone Valley.

And now you don’t see people like me when I was 19, just moving out to San Francisco chasing a dream. There was a time when the vitality of the underground was maintained by entire bands moving here as a unit. Everybody from MDC and the Dicks to DRI and later, Zen Guerilla, the only one I can think of in recent years, who dare tried to relocate to San Francisco were I believe No Doctors and Sixteen Bitch Pile-Up, and I’m not sure either one of them exist at this point. Maybe they all packed up and left. A lot of that underground fire, and that’s not just confined to rock of course, but a lot is going on in Oakland now.

SFBG Yeah, I’ve had a lot of bands telling me they can’t afford San Francisco anymore, so they’ve been moving to the East Bay or beyond…

JB I mean, I’d hate to see San Francisco turn any further into a giant Aspen, Colorado, or even Boulder, Colorado, which is where I fled from in order to come here [in ’78.]

SFBG Are there current East Bay or San Francisco bands that you feel like are doing good things?

JB Of course I always brain-fart on this question. Well, of course I’m going to support my label bands, I love Pins of Light.

SFBG How involved are you with Alternative Tentacles? Are you going out and finding bands?

JB Well I’m still the absentee-thought-lord, the buck stops with me. Someone deeply suspicious of capitalism has wound up owning a business by default, whether I should or not. Luckily there’s still money to pay a shrinking staff and to make sure we can keep putting out cool things. But it’s becoming harder and harder because of the combination of a crashed economy, rents going through the ceiling all over country, and file-sharing on the other hand. Of course, one feeds the other when people don’t have any money.

That doesn’t mean I support these misguided efforts, these major label RIAA scams to blackmail people and sue them for file-sharing. They’ve raked in over a hundred million dollars doing that and no artist has seen a penny. That’s not the way to solve this.

On the other hand, when I see one of the best bands we’ve seen in years like the Phantom Limbs break up way too soon, I can’t help but wonder whether file-sharing might be a part of the problem, with so many people going crazy over them and going to their shows all over the place, and then hardly anybody buys the album.

When you’ve got people in the age of high housing and transportation cost trying to keep themselves fed or also sustain a family, that hurts. I wonder how many people save up money from their shitty jobs for years in order to make some really cool piece of music only to find that nobody actually gives anything back; they’re that much more likely to quit making anything.

Maybe the solution is, for people who want to get their friends into really cool music, don’t just send them the whole album, pick some favorites and send them a little teaser package, a little file to inspire them to check out them more.

Not to mention, be conscious of whose file you’re sharing. Major labels go so far out of their way to rip off their artists anyways, with an army of lawyers to back them up. But when it’s an underground artist or label, that’s different. I never would have thought that GSL would’ve stopped, for example. Or that Touch and Go would draw mainly into reissues and back catalogue. It’s not just the economy and music industry crashed that’s to blame, it’s also people who don’t think artists should get any of their support.

SFBG Do you still love performing in front of a crowd? Do you have any recent performances with this band that you’ll take with you?

JB I’m not sure I’d be doing it if there wasn’t this inner need to do it. I’m really greatful that at my age anybody even cares about what I have to say, or new stuff I’ve been making.

We’ve been able to play a lot of places Dead Kennedys weren’t, because countries hadn’t opened up yet and they were still under the boot of Communist dictators or Latin American military or whatever. And we get to play for people in those places now. I don’t have the kind money where I can go jet-setting around to these places, I have to play my way to places like Buenos Aires or Slovenia, or I’ll never get there.

Bringing these musical riffs in my head to life and to have them actually work and getting to play them for people, that’s always pretty cool.

Some of the stranger moments were last time we were in Geneva we had a stage-diver in a wheelchair. The crowd was very gentle with him, passing him around, and making sure he was reunited with the chair, which was floating somewhere else in the crowd. Three or four songs later, he’d be back again! That was good.

Also, being able to scrape together just enough of my high school Spanish to be able to talk to people in Buenos Aires from the stage about some songs that were written with them in mind. I mean, “Bleed for Me,” the old Dead Kennedys song, was written about the Dirty Wars. And this was the first time I could actually dedicate “Bleed for Me” to the Desaparecidos in Argentina and explain it a little bit.

TOFU AND WHISKEY Jello Biafra could be your theatrical political science professor. The still-charismatic frontperson and song-composer has long spewed knowledge deep from the underbelly of political theater, from his influential early 1980s Bay Area punk band Dead Kennedys, and projects like the band Lard, through his nine dense spoken word albums, and up to his newest musical endeavor, louder than ever in his 50s, Jello Biafra and the Guantanamo School of Medicine.

That band, which also includes Victims Family guitarist Ralph Spight, plays the Uptown this weekend with D.I., the Divvys, and Gir-illa Biscuits — an excellent local Gorilla Biscuits tribute act (Fri/26, 9pm, $15. Uptown, 1928 Telegraph, Oakl. www.uptownnightclub.com.)

Given Biafra’s affinity for weaving news-worthy (though oft-overlooked) scandals into contextual lyrics, I have often wondered from where he gathered his news. “Why, the Bay Guardian, of course! Where would a local voter be without your fine rag?” Biafra tells me from his San Francisco home, while finishing up making a juice of apples and greens. Is he mocking me? “I just hope the new ownership and staff goes pedal to the metal to keep up the standard of muckraking and ethics. There’s so much corruption to dig up in this area.” No, his tone is just often sarcastic.

Guantanamo School of Medicine’s White People and the Damage Done (Alternative Tentacles, 2013) is the group’s most recent album. A semi-concept album, Biafra says it’s about “grand theft austerity, and how unnecessary it is.”

He explains, “People have asked me…what I think is the biggest problem in the world today and they expect me to say something like ‘climate change’… or inequality, or war, or whatever. I say you know, there’s a worse one, it’s corruption. Because that is what’s blocking anything constructive from being done about all those other problems.”

The title track of White People and the Damage Done, a pounding, guitar-heavy, Dead Kennedys-esque song, explicitly points a finger toward attitudes of the higher-ups in the US and EU regarding countries run by people of color, and the need to step in and take control.

Anthemic single “Shock-U-Py!” has a chantable chorus, and moment-in-time impact. In it, Biafra howls “Wake up and smell the noise/We can’t take it any more/Corporate coup must go/We will Occupy/We will Shock-U-py.” The Occupy movement may have left the mainstream radar for now, but Biafra’s song commemorated the moment, much like he did in early career chants calling out yuppies and atrocities in places like Cambodia, in the early ’80s. His lyrics are typically both rooted in the present, and packed with historical references.

A fast-paced earlier released track (still with that Biafra-esque carnivalian breakdown), “Dot Com Holocaust,” recorded at the time of the The Audacity of Hype EP (AT, 2009), touched on problems more local to Biafra and this rag, of gentrification and a new class of tasteless techies coming in to the Bay. Dripping with satire, the song seemed to have touched a nerve when first released, and garnered scores of angry, faceless Internet comments.

When we discuss newer bands, he notes many acts are fleeing SF for the East Bay, something bands across genre styles and influences have brought up with me during casual conversations and interviews.

“Now you don’t see people like me when I was 19, just moving out to San Francisco [from Boulder, Colo.], chasing a dream. There was a time when the vitality of the underground was maintained by entire bands moving here as a unit. Everybody from MDC and the Dicks to DRI and later, Zen Guerilla.”

But as an underground label owner (Alternative Tentacles) he knows times are tough for both bands and music fans, with a poisonous combination of the crashed economy and rampant file-sharing affecting all involved. “I wonder how many people save up money from their shitty jobs for years in order to make some really cool piece of music only to find that nobody actually gives anything back,” he says. “Maybe the solution for people who want to get their friends into really cool music, don’t just send them the whole album, pick some favorites and send them a little teaser package, a little file to inspire them to check out them more.”

YASSOU BENEDICT

Counterpoint, there are still some bands and artist types heading way out west to San Francisco in these turbulent, high-priced times: Yassou Benedict. This band is not in the slightest akin to Biafra’s people, though it is a group of hopeful young dreamers.

The shoegazing dreampop four-piece formed at a small high school in Upstate New York. While most bands from the area would migrate south to New York City, Yassou Benedict made the “fairly random” decision to head to SF. “We all got into a Subaru Forrester with a Great Dane in the back and all our stuff in a trailer and drove across country,” says guitarist James Jackson, who traveled with singer-bassist Lilie Bytheway-Hoy, guitarist-keyboardist A.J. Krumholz, and drummer Patrick Aguirre.

Now in the Bay, they work as servers at Outerlands, a cook at Beauty Bagels and Wise Sons, a bartender at the Boxing Room, and a pizza-dealer at Lanesplitter Pizza and Pub.

But more importantly, the group of 20-somethings recently released its debut EP, In Fits in Dreams, a moody, complex, emotionally fraught record that leaves the listener itching for a full-length, and touches on themes of “anxiety, and wanting to be weightless, the desire to run through wide open spaces.” The album release party was actually a few weeks back, but you can catch the band this week at Milk Bar with Beautiful Machines, Hotel Eden, and NVO (Fri/26, 8:30pm, $10. Led by Bytheway-Hoy’s dramatic, high-ranging vocals, and unconventional song structures (like shifting time signatures) In Fits in Dreams also features guest vocals by Hole’s Melissa Auf Der Maur on track “Cloisters.”

The subtle beats and rolling vocals of “Cloisters” feels like a doomed march toward the unknown, while closer “Last Cicada” ventures more into Radiohead In Rainbows territory (the band has been known to cover “Jigsaw Falling Into Place”). There’s also the church-like pop hymn of “Back Roads that Dead End,” which begins as an anxious vocal solo with faraway chimes, the beats and guitars slowing filtering in.

It’s surely been noted elsewhere on the blogosphere, but there’s something strangely seductive within Yassou Benedict, which I mention to Jackson. “I am not sure why that is. If we are making people feel, whether it is the desire to make love, or children or anything else, than we are succeeding. It is kind of strange though. Our music is fairly depressing. Now I’m just imaging people holding each other and crying while they listen. Lilie’s voice probably has a lot to do with that.” Bytheway-Hoy’s voice is indeed both haunting and captivating.

There’s also a cinematic quality to In Fits in Dreams, likely driven by that high emotional tug. Given the soundtrack capabilities, I asked Jackson what type of film would best be suited to Yassou Benedict and he picked a future Wes Anderson film, also noting that a dream opening slot would be an imaginary Radiohead show in an intimate venue (no arenas!).

While the record was recorded and produced back in Hudson, NY (with Steve Durand at Dioramaland Studios), the band is touring on it from its new homebase in the Bay.

 

Giraudo (and activists) close CPMC deal

The takeaway message from a July 11 press conference held in the Mayor’s Office touting legislation authorizing California Pacific Medical Center’s construction of two new San Francisco hospitals was seemingly this: Everyone hearts Lou Giraudo.

A part owner of Boudin Bakery and former president of the San Francisco Police Commission, Giraudo was called in last year to help mediate a deal that seemed doomed when CPMC, city officials, and a coalition of labor and community organizations were unable to hash out an agreement that was acceptable to all sides.

Negotiations have been contentious over the past year due to early indications that CPMC would not guarantee that St. Luke’s, a health care facility relied upon by many low-income San Franciscans, would keep its doors open as a condition of moving forward with the new Cathedral Hill facility, a centerpiece of CPMC’s $2.5 billion project.

Enter Giraudo, who was, according to a not-so-subtle hint dropped by former Mayor Willie Brown in his San Francisco Chronicle column last year, “quietly brought in” by the mayor’s office to fix the half-baked mess that the CPMC deal had evidently devolved into.

Sup. David Campos sang Giraudo’s praises, saying, “I have yet to meet a finer public servant,” and calling Giraudo “a real hero of mine.”

Giraudo himself told the Guardian that his strategy was “to de-politicize the process and get people to think about the community.”

Board President David Chiu, who worked closely with Campos and Sup. Mark Farrell to negotiate with CPMC and other parties on behalf of the Board, went so far as to compare Giraudo to Batman. He even joked that he was going to shine a bat signal the next time a negotiator was needed, in hopes that Giraudo would save the day.

Yet while Giraudo may have provided the catalyst needed for a deal, it was community advocates who ensured that the public at large benefited from the CPMC plan more than they would have otherwise — since the mayor’s office seemed willing to go along with the health care giant’s original terms.

Long before Giraudo’s involvement, a coalition of labor and community organizations waged a campaign to rebuild CPMC “the right way,” holding strong on the issue of St. Lukes and refusing to agree to anything that would leave open the possibility that the hospital, a critically important facility for low-income patients, would be shuttered. “That coalition has been working for quite some time … to save St. Lukes,” Campos said of the diverse coalition of community and labor leaders, who formed under the name San Franciscans for Healthcare, Housing, Jobs and Justice. “It kept working for many years.” Under the terms of the agreement that was ultimately agreed upon, St. Luke’s will have a number of specified services to ensure it remains a full-service hospital, and CPMC will commit to providing services to 30,000 charity care patients and 5,400 Medi-Cal managed care patients per year. CPMC will also contribute $36.5 million to the city’s affordable housing fund, and it will pay $4.1 million to replace the homes it displaces on Cathedral Hill. While many advocates for San Francisco’s most vulnerable populations heralded the deal, some were disheartened that it did not dedicate space for psychiatric care.

The next time you get drunk off PBR while gorging yourself on sourdough baked into the shape of a teddy bear, or for that matter receive emergency medical care at St. Luke’s after an unsuccessful attempt at building a DIY jetpack, you’ll know who to thank.

Willie’s shady role in Tim’s San Francisco

The Guardian’s longtime but recently ousted editor Tim Redmond continues to do excellent, important work through his Tim’s San Francisco blog, including stories today on the Chronicle’s blackout of yesterday’s big City College protest and the invasive tactics of online marketers.

But it was a story that he wrote yesterday that really should get wider play in the local media: a recent court case showed how Willie Brown received a whopping $750,000 to lobby for a local developer involved in the politically uber-juiced Transbay real estate deal. Tim builds off of the San Francisco Business Times article that broke the story and his own reporting for the Guardian questioning why Brown isn’t registered as a lobbyist.

“Nobody else is looking at the story, but it’s actually pretty big news. It sheds light on the huge amounts of money that get thrown around when someone’s trying to build a commercial office tower in San Francisco. It shows how much of a player Brown is and how much influence he’s seen to have under the Lee Administration,” Tim wrote.

Indeed, particularly given the huge and ethically question platform that the Chronicle hands Brown with his Sunday column, and the role that Brown played installing Lee into Room 200, where he’s carried water for Brown’s clients, this is a story that deserves far more attention and scrutiny.
