The lobbyist loophole

EDITORIAL As the stories in this issue show, open government laws are critical to democracy. Without the city’s sunshine law, we wouldn’t know how the proposal to give Twitter a tax break ballooned into a major giveaway. Without the sunshine laws, Tim Crews, the embattled publisher of the Sacramento Valley Mirror, wouldn’t have been able to use his small paper to hold public officials accountable.

That’s why the laws on the books need to be enforced — and sometimes strengthened. One example in San Francisco is the lobbyist registration requirement.

Here’s the problem: Former Mayor Willie Brown, who now works for at least two major outfits with business before City Hall. As Tim Redmond reports on page 10, Pacific Gas and Electric Co. paid Brown some $480,000 in 2007 and 2008. And although Brown is a lawyer, nobody can honestly believe that was for legal work. He was clearly paid to give the embattled utility political advice and to pull political strings. And PG&E has major interests at City Hall — San Francisco is trying to set up a community choice aggregation system that PG&E opposes, and (of course) the utility has spent almost 90 years trying to block public power in this town. There are dozens of other city issues, from facility safety to the franchise fee, that affect PG&E’s bottom line.

Has Brown tried to influence city officials on behalf of the utility? The public has no way to know. By law, any individual who lobbies for a private client (and earns more than $3,000 a quarter doing so) has to register with the Ethics Commission, reveal his or her clients, and report on all contacts with city officials. Brown has never done that.

Brown also works for the owners of the Fairmont Hotel, who want the right to convert hotel rooms to condos. Mayor Ed Lee just submitted legislation giving the hoteliers what they want, and Brown is Lee’s political mentor. Connection?

The public has a right to know who’s trying to do what deals behind closed doors; that’s why the city has a lobbyist registration law. The voters have a right to know whether lobbyists are giving money to elected officials; that’s why the law requires registered lobbyists to itemize those contributions. But it’s not always honored — and as Brown shows, it can be openly defied. And nothing happens.

Part of the problem is that the Ethics Commission has been far too lax in pursuing enforcement of the laws. The agency lacks the resources to do serious investigations. As a result, its director John St. Croix told us, all the staff can do is respond to complaints. But even with the limited money it has, the commission can do a lot more. Public hearings on the failures of lobbyist registration and campaign contribution reporting would be a good first step. And how hard would it be to cross-check campaign filings with lobbyist filings to see which lobbyists don’t properly report their contributions? A simple computer program could do that in a few minutes.

The commission also needs to do a better job making its funding case to the supervisors. The utter lack of serious enforcement of laws involving powerful interests doesn’t instill confidence in the agency.

But the law is also vague in parts, and the supervisors need to fix it. A clearer definition of “lobbyist” is a clear mandate. And enforcement needs to be increased. Willful violation of the state’s Political Reform Act is a misdemeanor crime. Violating the city’s lobbyist law should be too.

Editorial: The Willie Brown loophole

As the stories in this issue show, open government laws are critical to democracy. Without the city’s sunshine law, we wouldn’t know how the proposal to give Twitter a tax break ballooned into a major giveaway. Without the sunshine laws, Tim Crews, the embattled publisher of the Sacramento Valley Mirror, wouldn’t have been able to use his small paper to hold public officials accountable.

That’s why the laws on the books need to be enforced — and sometimes strengthened. One example in San Francisco is the lobbyist registration requirement.

Here’s the problem: Former Mayor Willie Brown, who now works for at least two major outfits with business before City Hall. As Tim Redmond reports on page 10, Pacific Gas and Electric Co. paid Brown some $480,000 in 2007 and 2008. And although Brown is a lawyer, nobody can honestly believe that was for legal work. He was clearly paid to give the embattled utility political advice and to pull political strings. And PG&E has major interests at City Hall — San Francisco is trying to set up a community choice aggregation system that PG&E opposes, and (of course) the utility has spent almost 90 years trying to block public power in this town. There are dozens of other city issues, from facility safety to the franchise fee, that affect PG&E’s bottom line.

Has Brown tried to influence city officials on behalf of the utility? The public has no way to know. By law, any individual who lobbies for a private client (and earns more than $3,000 a quarter doing so) has to register with the Ethics Commission, reveal his or her clients, and report on all contacts with city officials. Brown has never done that.

Brown also works for the owners of the Fairmont Hotel, who want the right to convert hotel rooms to condos. Mayor Ed Lee just submitted legislation giving the hoteliers what they want, and Brown is Lee’s political mentor. Connection?

The public has a right to know who’s trying to do what deals behind closed doors; that’s why the city has a lobbyist registration law. The voters have a right to know whether lobbyists are giving money to elected officials; that’s why the law requires registered lobbyists to itemize those contributions. But it’s not always honored — and as Brown shows, it can be openly defied. And nothing happens.

Part of the problem is that the Ethics Commission has been far too lax in pursuing enforcement of the laws. The agency lacks the resources to do serious investigations. As a result, its director John St. Croix told us, all the staff can do is respond to complaints. But even with the limited money it has, the commission can do a lot more. Public hearings on the failures of lobbyist registration and campaign contribution reporting would be a good first step. And how hard would it be to cross-check campaign filings with lobbyist filings to see which lobbyists don’t properly report their contributions? A simple computer program could do that in a few minutes.

The commission also needs to do a better job making its funding case to the supervisors. The utter lack of serious enforcement of laws involving powerful interests doesn’t instill confidence in the agency.

But the law is also vague in parts, and the supervisors need to fix it. A clearer definition of “lobbyist” is a clear mandate. And enforcement needs to be increased. Willful violation of the state’s Political Reform Act is a misdemeanor crime. Violating the city’s lobbyist law should be too.

 

Noise Pop Live Review: Dominant Legs and How to Dress Well

Synth and bass, rock and roll, some combinations are easily matched, but when you put How to Dress Well on the roster, pairings aren’t as obvious. Dominant Legs‘ mangy pop was an odd precursor to Saturday night’s How to Dress Well performance at Cafe Du Nord, but then again, what flatters eerie falsetto and awkward emotions? 

San Francisco’s Dominant Legs played like summer in a bottle. Happy guitars, lots of cowbell and rad bass made the winter weather outside melt. The only thing missing was sunshine, or lights in general. Half the band was hidden from the crowd due to a lack of lighting– particularly the adorable Hannah Hunt. One disgruntled lady in the audience voiced her disapproval by shouting, “We can’t see the pretty girl in the blue dress,” to which Hunt meekly responded, “It’s green.” Case in point. 

The band of five played three brand new songs, two cute and sleepy and one with tropical breeze, but the hits were any that picked up the pace. The real gem was as suspected– “Young at Love and Life.”

There was a brief interlude by Shlohmo and his way cool collection of old school tracks, including my personal favorite, TLC’s “If I Was Your Girlfriend”– brought me right back to Mr. Burg’s fifth grade class.

Then the stage cleared. A lazy stream of fog seeped from a small machine in the corner as Tom Krell grabbed the mic. Immediately things felt awkwardly intimate as the man behind How to Dress Well told the crowd, “This week things have been kind of tough for me,” said Krell. “But I guess we’ll see how it goes.” And it went in all kinds of ways: uncomfortable, pretty, sexy and repulsive. It was Krell, naked (only figuratively), revealing every last detail of his diary in a high-pitched squeal of sorts, accompanied by super smooth, shattering bass, electronics and R&B stylings. 

At first it seemed like a bad dream. My ears hurt. I thought slitting my wrists sounded like a nice alternative to listening to songs entitled, “Suicide Dream 1” and “Suicide Dream 2.”  I did enjoy the projected visual art and it seemed to pair well with the horror escaping his lips. I couldn’t believe all these people had paid to see this guy. Was this a joke? I turned to the dude next to me (just as his friend offered up some Flamin’ Hot Cheetos) and asked him if he ‘really liked this?” He laughed. “Uh…no comment.” Then he thought about it for a second more. “Well, I don’t hate it.”

And surprisingly by the end of his one-man show I realized I also didn’t ‘hate it’ but couldn’t quite get to the ‘liking’ part either. I grew to respect the dude for what he brought to the table. Krell has balls. Really big balls. Who else would stand up there and tell everyone that this song is about how his life “feels closed,” instead of “feeling open, like when I was young.” It was hipster poetry hour and I needed a cigarette. That’s some depressing shit, man. If only I could’ve understood the actual lyrics. Were those real words?

How to Dress Well is what it is, folks but whether it counts as live music, a band or a quality performance is still up for debate. The transition from amazing recorded material to live act still has some kinks; or maybe that’s the intention and you’re cool and totally hip if you get it. I’ve never been one to understand ‘performance art.’ Instead it seems easier to categorize this fiasco as another talented bedroom musician lured from his comfort zone, into the outdoors and onto stages. We should stop being so pushy.

 

 

Meet the new boss

The Guardian hasn’t been invited into City Hall’s Room 200 for a long time. Former Mayor Gavin Newsom, who frequently criticized this newspaper in his public statements, had a tendency to freeze out his critics, adopting a supercilious and vinegary attitude toward any members of the press who questioned his policy decisions. So it was almost surreal when a smiling Mayor Ed Lee cordially welcomed two Guardian reporters into his stately office Feb. 15.

Lee says he plans to open his office to a broader cross-section of the community, a move he described as a way of including those who previously felt left out. Other changes have come, too. He’s replaced Newsom’s press secretary, Tony Winnicker, with Christine Falvey, former communications director at the Department of Public Works (DPW). He’s filled the Mayor’s Office with greenery, including giant tropical plants that exude a calming green aura, in stark contrast to Newsom — whose own Room 200 was sterile and self-aggrandizing, including a portrait of Robert Kennedy, in whose footsteps Newsom repeatedly claimed to walk.

When it comes to policy issues, however, some expect to see little more than business-as-usual in the Mayor’s Office. Democratic Party chair Aaron Peskin, a progressive stalwart, said he sees no substantive changes between the new mayor and his predecessor. “It seems to me that the new administration is carrying forward the policies of the former administration,” Peskin said. “I see no demonstrable change. And that makes sense. Lee was Willie Brown and former Mayor Gavin Newsom’s handpicked successor. So he’s dancing with the guys that brought him in.”

Sup. David Campos, viewed as part of the city’s progressive camp along with Peskin, took a more diplomatic tack. “So far I’ve been very pleased with what I’ve seen,” Campos noted. “I really appreciate that he’s reached out to the community-based organizations and come out to my district and done merchant walks. I think we have to wait to see what he does on specific policy issues.”

But while Lee has already garnered a reputation for being stylistically worlds apart from Newsom, he still hews close to his predecessor’s policies in some key areas. In our interview, Lee expressed an unwillingness to consider tax-revenue measures for now, but said he was willing to take condo conversions into consideration as a way to bring in cash. He was unenthusiastic about community choice aggregation and dismissive of replacing Pacific Gas & Electric Co. with a public-power system. He hasn’t committed to overturning the pending eviction of the Haight Ashbury Neighborhood Council’s recycling center, and he continued to argue for expanding Recology’s monopoly on the city’s $206 million annual trash stream, despite a recent Budget and Legislative Analyst’ report that recommended putting the issue to the voters.

Public Defender Jeff Adachi, who met Lee in 1980 through the Asian Law Caucus, said Lee would be facing steep challenges. “It’s a fascinating political karmic outcome that he is now our appointed mayor. He didn’t seek it out, as he says, but the opportunity he has now is to focus his efforts on fixing some of the problems that have gone unaddressed for decades, pension reform being one of them. I think he realizes he has a limited time to achieve things of value. The question I and others have is, can he do it?”

 

THE RELUCTANT MAYOR

Lee identified as a non-politician, patently rejecting the notion that he would enter the race for mayor. In meetings with members of the Board of Supervisors at the end of 2010, he said he didn’t want the job.

Yet while vacationing in Hong Kong, Lee became the subject of a full-court press. “When the lobbying and phone calls started … clearly they meant a lot to me,” Lee told us, adding that the choice “was very heavy on my mind.” He finally relented, accepting the city’s top post.

Although rumors had been circulating that Lee might seek a full term, he told the Guardian he’s serious about serving as a caretaker mayor. “If I’m going to thrust all my energy into this, I don’t need to have to deal with … a campaign to run for mayor.”

Adachi offered an interesting take on Lee as caretaker: “Somewhere along the way, [Lee] became known as the go-to guy in government who could take care of problems,” Adachi said, “like the Wolf in Pulp Fiction.”

Sounding rather unlike Harvey Keitel’s tough-talking character, Lee noted, “One of my goals is to rebuild the trust between the Mayor’s Office and the Board of Supervisors. I think I can do that by being consistent with the promises I make.”

Lee’s vows to keep his promises, mend rifts with the board, and stay focused on the job could be interpreted as statements intended to set him apart from Newsom, who was frequently criticized for being disengaged during his runs for higher office, provoking skirmishes with the board, and going back on his word.

The new mayor also said he’d be willing to share his working calendar with the public, something Newsom resisted for years. Kimo Crossman, a sunshine advocate who was part of a group that began submitting requests for Newsom’s calendar in 2006, greeted this news with a wait-and-see attitude. “I’ve already put in a request,” Crossman said. “Politicians are always in support of sunshine — until they have to comply with it.”

 

THE ELEPHANT IN THE ROOM

Pointing to the tropical elephant-ear plants adorning his office, Lee noted that elephants are considered lucky in Chinese culture. With the monstrous issues of pension reform and a gaping budget deficit hitting his mayoral term like twin tornadoes, it might not hurt to have some extra luck.

Pension reform is emerging as the issue du jour in City Hall. A round of talks on how to turn the tide on rising pension costs has brought labor representatives, Sup. Sean Elsbernd, billionaire Warren Hellman, City Attorney Dennis Herrera, labor leaders, and others to the table as part of a working group.

Gabriel Haaland, who works for SEIU Local 1021, sounded a positive note on Lee. “He’s an extraordinarily knowledgeable guy about government. He seems to have a very collaborative working style and approach to problem-solving, and he is respectful of differing opinions,” Haaland said. “Where is it going to take us? I don’t know yet.”

Lee emphasized his desire to bring many stakeholders together to facilitate agreement. “We’re talking about everything from limiting pensionable salaries, to fixing loopholes, to dealing with what kinds of plans we can afford in the health care arena,” he noted. Lee said the group had hashed out 15 proposals so far, which will be vetted by the Controller’s Office.

A central focus, Lee said, has been “whether we’ve come to a time to recognize that we have to cap pensions.” That could mean capping a pension itself, he said, or limiting how much of an employee’s salary can be counted toward his or her pension.

Since Lee plans to resume his post as city administrator once his mayoral term has ended, he added a personal note: “I want to go back to my old job, do that for five years, and have a pension that is respectable,” he said. “At the same time, I feel others who’ve worked with me deserve a pension. I don’t want it threatened by the instability we’re headed toward and the insolvency we’re headed toward.”

 

BRACING FOR THE BUDGET

If pension reform is shaping up to be the No. 1 challenge of Lee’s administration, tackling the city budget is a close second. When Newsom left office, he passed Lee a budget memo containing instructions for a 2.5 percent reduction in most city departments, part of an overarching plan to shave 10 percent from all departments plus another 10 percent in contingency cuts, making for a bruising 20 percent.

Lee said his budget strategy is to try to avert what Sup. David Chiu once characterized as “the typical Kabuki-style budget process” that has pitted progressives against the mayor in years past. That means sitting down with stakeholders early.

“I have opened the door of this office to a number of community groups that had expressed a lot of historical frustration in not being able to express to the mayor what they feel the priorities of their communities are,” Lee said. “I’ve done that in conjunction with members of the Board of Supervisors, who also felt that they weren’t involved from the beginning.”

Affordable-housing advocate Calvin Welch said Lee’s style is a dramatic change. “I think he’s probably equaled the total number of people he’s met in six weeks with the number that Newsom met in his seven years as mayor,” Welch said.

Sup. Carmen Chu, recently installed as chair of the Budget & Finance Committee, predicted that the budget will still be hard to balance. “We are still grappling with a $380 million deficit,” Chu told us, noting that there are some positive economic signs ahead, but no reason to expect a dramatic improvement. “We’re been told that there is $14 million in better news. But we still have the state budget to contend with, and who knows what that will look like.”

Sup. John Avalos, the former chair of the Board’s powerful Budget Committee, said he thinks the rubber hasn’t hit the road yet on painful budget decisions that seem inevitable this year — and the outcome, he said, could spell a crashing halt to Ed Lee’s current honeymoon as mayor.

“We are facing incredible challenges,” Avalos said, noting that he heard that labor does not intend to open up its contracts, which were approved in 2010 for a two-year period. And federal stimulus money has run out.

 

DID SOMEONE SAY “CONDO CONVERSIONS”?

Asked whether he supported new revenue measures as a way to fill the budget gap, Lee initially gave an answer that seemed to echo Newsom’s inflexible no-new-taxes stance. “I’m not ready to look at taxes yet,” he said.

He also invoked an idea that Newsom proposed during the last budget cycle, which progressives bitterly opposed. In a conversation with community-based organizations about “unpopular revenue-generating ideas,” Lee cautioned attendees that “within the category of unpopular revenue-generating ideas are also some that would be very unpopular to you as well.”

Asked to explain, Lee answered: “Could be condo conversion. Could be taxes. I’m not isolating any one of them, but they are in the category of very unpopular revenue-generating ideas, and they have to be carefully thought out before we determine that they would be that seriously weighed.”

Ted Gullicksen, who runs the San Francisco Tenants Union, said tenant advocates have scheduled a meeting with Lee to talk about condo conversions. Thanks to Prop. 26’s passage in November 2010, he said, any such proposal would have to be approved by two-thirds of the board or the voters. “It’s pretty clear that any such measure would not move forward without support from all sides,” Gullicksen said. “If anyone opposes it, it’s going to go nowhere.”

Gullicksen said he’d heard that Lee is willing to look at the possibility of significant concessions to renter groups in an effort to broker a condo conversion deal, such as a moratorium on future condo conversions. “If, for example, 1,000 TICs [tenants-in-common] became condos under the proposal, then we’d need a moratorium for five years to minimize and mitigate the damages,” Gullicksen explained.

More important, some structural reform of TIC conversions may be on the table, Gullicksen said. “And that would be more important than keeping existing TICs from becoming condos.”

Gullicksen acknowledged that Lee has the decency to talk to all the stakeholders. “Newsom never attempted to talk to tenants advocates,” he said.

 

GREEN, WITHIN LIMITS

Lee’s two children are in their early 20s, and the mayor said he takes seriously the goal of being proactive on environmental issues in order to leave them with a more sustainable San Francisco. He trumpeted the city’s green achievements, saying, “We’re now on the cutting edge of environmental goals for the city.”

Leading bicycle activist Leah Shahum of the San Francisco Bicycle Coalition had praise for Lee on bike issues. “I’m really encouraged by his very public support of the new green separate bikeways on Market Street and his interest and commitment to creating more,” she said. “I believe Mayor Lee sees the value of connecting the city with cross town bicycle lanes, which serve a wide range of folks, including business people and families.”

Yet some proponents of green causes are feeling uncertain about whether their projects will advance under Lee’s watch.

On the issue of community choice aggregation (CCA), the ambitious green-energy program that would transfer Pacific Gas & Electric Co. customers to a city-run program with a cleaner energy mix, Lee — who helped determine rates as city administrator — seemed lukewarm. “I know Mr. [Ed] Harrington and his staff just want to make sure it’s done right,” he said, referring to the general manager of the city’s Public Utilities Commission, whose tepid attitude toward the program has frequently driven him to lock horns with the city’s chief CCA proponent, Sup. Ross Mirkarimi.

Lee noted that CCA program goals were recently scaled back. He also said pretty directly that he opposes public power: “We’re not in any day getting rid of PG&E at all. I don’t think that is the right approach.”

The controversial issue of the Haight Ashbury Neighborhood Council Recycling Center’s pending eviction from Golden Gate Park still hangs in the balance. The Recreation and Park Commission, at Newsom’s behest, approved the eviction despite overwhelming community opposition.

Lee said he hadn’t looked at the issue closely. “I do know that there’s a lot of strong debate around the viability, what that operation attracts and doesn’t attract,” he said. “I had the owner of HANC here along with a good friend, Calvin Welch, who made a plea that I think about it a bit. I agreed that I would sit down and talk with what I believe to be the two experts involved in that decision: Melanie Nutter at the Department of the Environment and then Phil Ginsburg at the Rec and Park.” Nutter and Ginsburg supported HANC’s eviction.

Welch, who is on the board of HANC, noted that Lee could be swayed by his staff. “The bunch around Newsom had old and bad habits, and old and bad policies. In dealing with mayors over the years, I know how dependent they are on their staff. They’re in a bubble, and the only way out is through a good staff. Otherwise, Lee will come to the same conclusions as Newsom.”

HANC’s Jim Rhoads told the Guardian he isn’t feeling reassured. “He said he would keep asking people about it. Unfortunately, if he asked his own staff, it would be a problem because they’re leftovers from Newsom.”

Speaking of leftovers, Lee also weighed in on the debate about the city’s waste-management contract — and threw his support behind the existing private garbage monopoly. Campos is challenging a perpetual waste-hauling contract that Recology has had with the city since 1932, calling instead for a competitive-bidding process. When the Department of the Environment recommended awarding the city’s landfill disposal contract to Recology last year, it effectively endorsed a monopoly for the company over managing the city’s entire waste stream, at an estimated value of $206 million per year.

The final decision to award the contract was delayed for two months at a February Budget & Finance Committee hearing. Campos is contemplating putting the issue to the voters this fall, provided he can find six votes on the Board.

“I know that Sup. Campos had given his policy argument for why he wants that revisited,” Lee said. “I have let him know that the Recology company in its various forms has been our very dependable garbage-hauling company for many, many decades. … I feel that the company has justified its privilege to be the permit holder in San Francisco because of the things that it has been willing to do with us. Whether or not we want to use our time today to revisit the 1932 ordinance, for me that wouldn’t be a high priority.”

 

UNFINISHED BUSINESS

In the last week of 2010, Avalos pushed through groundbreaking local-hire legislation, without the support of then Mayor Gavin Newsom or his chief of staff, Steve Kawa, who wanted Avalos to back off and let Newsom takeover the task.

With Lee now in Room 200, things appear to be moving forward on local hire, in face of misleading attacks from Assemblymember Jerry Hill (D-San Mateo), who wants to make sure no state money is used on local-hire projects, presumably because the building trades are upset by it. And Kawa, whom Lee has retained as chief of staff, doesn’t really support the legislation. Indeed, Kawa’s presence in the Mayor’s Office has his detractors believing that the new boss in Room 200 is really the same as the old boss.

“I feel like things are moving forward in the right direction around local hire, though a little more quietly than I’d like,” Avalos told the Guardian. Avalos noted that he is going to hold a hearing in March on implementing the legislation that should kick in March 25.

Welch said he believes that if Lee starts replacing staff wholesale, it could indicate two things: he’s a savvy guy who understands the difficulties of relying on Newsom’s chief of staff Steve Kawa for a budget, and he’s not ruling out a run for mayor.

“If I was in his position, the first thing out of my mouth would be, ‘I’m not running.’ I think he’s very focused in the budget. And it’s going to make or break him. But if he starts overriding Kawa and picks staff who represent him … well, then I’d revisit the question of whether he’s contemplating a run for mayor, say, around June.”

Noise Pop 2011 highlights

MUSIC The 2011 edition of Noise Pop finds the festival stretching the definition of noise pop ever further outward in order to swallow excellent sounds. Back in 1993, when Noise Pop originated, muted My Bloody Valentine-derivative bands with lowercase names evocative of junior-high lunch were the norm. This year, the fest taps into the recent, more sharp-edged shoegaze revival and the current California garage rock zeitgeist, while also making room for hip-hop, freak folk, and deep funk. It’s safe to say that, unlike the character assassinated in Steely Dan’s “Hey 19,” Noise Pop at 19 knows about the queen of soul. Here’s our guide to some of the event’s best lineups.

PEANUT BUTTER WOLF AND DÂM-FUNK: THE DISCOVERERS

It’s the midnight hour on Valentine’s Day in Portugal when I reach Dâm-Funk, a.k.a. Damon Riddick, on the phone. He’s just outside of Lisbon, his surroundings are “phenomenal,” and he’s ready to wax enthusiastic about his longtime partner in funk Peanut Butter Wolf. “Me and Chris [Manak, a.k.a. Peanut Butter Wolf] connect on that sound because we remember and we revere,” he says, when I ask about their shared love of soul, hip-hop, and funk. “We knew what it was like before cable television and the Internet existed, we remember everything from those early VHS tapes to the way the sun set.”

As the sun is still rising on Valentine’s Day, in L.A., the man Dâm-Funk calls “Wolf” for short shows similar brotherly love. “When Dâm met me, we had a mutual respect,” says Manak. “He saw my record collection and vice-versa. When we discover songs, we’ll say, ‘Check this out.'” In turn, this shared enthusiasm, and the positive response to Dâm-Funk’s albums Toeachizown and Adolescent Funk — both released on Manak’s label, Stones Throw – has recharged funk sounds in Los Angeles and SF, and led to new discoveries of soulful and funky treasures from the recent past.

One such gem is Jeff Phelps’ 1985 Magnetic Eyes, a Tascam Portastudio 244 bedroom recording with sensational vocals by Antoinette Marie Pugh, who stars in a terrific no-budget video for the album’s “Hear My Heart” currently up on YouTube. “That album is something I’ve known about for a long time,” Dâm-Funk says, when I mention Magnetic Eyes and its hand-drawn yet futuristic cover art. “It’s a great project.”

Another great project is Tony Cook’s Back to Reality (Stones Throw), a collection of mid-1980s recordings by a musician who got his start as James Brown’s drummer. Taking on the role of executive producer, Manak has added some extra pop to the already formidable strut of Cook songs such as “Heartbreaker,” even drafting in Dâm-Funk to contribute new vocals to one track, “What’s On Your Mind.” “You’d think they were 24-track recordings, but he [Cook] only worked on an 8-track,” marvels Manak. “He was a good musician and producer – when you’re bouncing tracks, you have to know what you’re doing. In those days it was hard to achieve a full sound like that.”

These days, both Dâm-Funk and Peanut Butter Wolf know what they’re doing — and that’s a damn lot. Reflecting his Gemini nature, Dâm is planning to explore the dark side on an EP with that title before venturing into the light on his next LP. He’s also remixed Nite Jewel and is collaborating with her on a project, Nite Funk. He’s producing music by Steve Arrington for Stones Throw, and he wants to put out another chapter of his archival venture Adolescent Funk, with him choosing the tracks instead of Manak. As for the man Dâm calls “Wolf,” he’s got Stones Throw’s 15th anniversary on his hands, including a 7-inch box set, and a series of live-to-vinyl performances by the label’s artists in L.A. DOMINANT LEGS: LOST IN LOVE

Whether he’s raging in the streets alongside fellow Giants maniacs or musically lost between the sheets, Dominant Legs’ Ryan Lynch sounds like he’s sweet to the core—and even more. “I didn’t have anything to do with setting the mattress on fire, but I was there,” says the SF musician of SF’s impromptu World Series throw-downs. “But I wasn’t stopping anybody from celebrating.”

Lynch also rolls with the love when it comes to music. “I don’t really listen to much music that would be characterized as aggressive,” he continues, on one of those sunny Bay afternoons that make it easy to float away on blue skies and daydreams. “I listen to pop music and, honestly, mostly KISS FM.” His favorite song on this crisp, creamy day is R. Kelly’s “Lost in Your Love.” “It’s all about him wanting to bring love songs back to the radio,'” Lynch adds. “And that’s sort of what I also aspire to—not that we get any radio play!”

But, oh, a girl — or a boy who once was a Girl (until recently, Lynch was Girls’ touring guitarist) — can dream. And dreams have been coming true for Lynch, a longtime Giants follower who recently contributed “Finally Champions” to a digital-only benefit comp of Giants tribute songs released by True Panther. Meanwhile Dominant Legs continues to pick up steam—and members.

Once the repository of Ryan’s solo singer-songwriter imaginings away from longtime band Magic Bullets, Dominant Legs found favor when the Redwood City-bred musician was laid off from his job as mail clerk-receptionist at a law firm. He didn’t sink his sparse funds into job retraining classes or the like; instead he bought a cheap Casio keyboard and drum machine. “I shouldn’t have been spending any money,” he recalls now. “But the direction of the music really took off after acquiring those pieces of musical equipment.” Friend Hannah Hunt, who had just graduated from college, offered to help out at a 2009 show at Amnesia and ended up sticking around.

“She brought a softness, and delicacy, which made the songs more delicate since her voice is so different from mine,” he observes. “I think her voice is easier on the ear than mine.” For Noise Pop, the two have acquired a few more legs to help them on their way: drummer Rene Solomon, bassist Andrew Connors, and guitarist Garrett Godard, the latter once the drummer for Girls.

They’ll be filling out the already intoxicating pop bounding off Dominant Legs’ 2010 EP, Young at Love and Life (Lefse), which has inspired music bloggers to go wild, tossing out scattershot, albeit flattering allusions to Orange Juice and Belle and Sebastian, Kelley Polar and Arthur Russell—and even Dave Matthews. Feeling lost again? Just listen to the earnestly lovelorn, gently bopping, synth-popping tunes like the title track and “Clawing Out at the Walls,” with its curious admixture of sweetness and self-doubt. Kindred spirits and modern lovers such as Jeremy Jay and Camera Obscura, also given to such exquisitely anxious reveries, would understand. “The only thing I’ve heard is that [the EP] is too heavily influenced by the ’80s,” says Lynch. “But I don’t see that as a problem.” (Kimberly Chun)

ADMIRAL RADLEY: LIFE AFTER GRANDADDY

Jason Lytle has never been shy in revealing the frustrations leading up to Grandaddy’s demise. Exhaustion from middling success, a love/hate relationship with his lifelong home of Modesto, and a diminished interest in making music with others resulted in a move to Montana to focus on a solo career in 2006. Enter Admiral Radley, a collaboration with members of indie-pop group Earlimart and Grandaddy drummer Aaron Burtch that has him not only playing in a band again, but touring Japan and singing about his former home on songs such as the sarcastic “I Heart California.” Lytle took some time out from a snowy day of magazine shopping at Borders in his new hometown of Bozeman to talk about the project.

SFBG Rumors of a collaboration between you and Earlimart date back to the Grandaddy days. What led to you guys finally working together?

Jason Lytle It was really an excuse to hang out at [Aaron Espinoza’s] studio and just have people coming in and playing parts. We set aside a week as a fun little project. Maybe somebody else had other plans for it, but at the time, I was convinced it was just gonna be a cool opportunity to make a record and be done with it.

SFBG Were you guys surprised by the amount of excitement surrounding the project?

JL Yeah. Then it turned into, alright, we gotta name this record something, and give the band a name, and pretty soon it was this real entity. The Japan thing started off as a joke, and then became more of, “Let’s give this a go, and if it winds up getting us to Japan, we can call it good” — and the whole thing was worth it.

SFBG And how were the Japan shows?

JL They were really scrappy. The places were just dumps. I kept joking with Aaron, saying, “If we weren’t in Japan right now, and if these weren’t exceptional circumstances, there’s no way I’d be putting up with this.”

SFBG You’d expressed some skepticism about playing in bands again after Grandaddy split. Has this experience changed your opinion?

JL My place in Admiral Radley is totally different from what my situation was with Grandaddy. I’m getting off easy. Aaron is a great organizer and knows that a big appeal for me joining the band was not dealing with a lot of the day-to-day crap I used to deal with. I feel like I’m a piece of a puzzle with this band, which after all these years is something I’ve never really experienced. So it’s been kind of neat.

SFBG Both you and Aaron like being hands-on with production in your work. How was the collaborative process on this album?

JL That part was pretty effortless. Aaron and I share a lot of the same philosophies on production and making albums sound a certain way. I definitely sat in on some of the mixing, but there was a lot of it where I was just able to trust what he was going to do, knowing that it probably wouldn’t be too far off from what I’d do myself.

SFBG Was it strange writing lyrics about California now that you’ve been gone for almost five years?

JL I’ve definitely had a renewed perspective. Every time I visit or I’m there doing some work, I’m thrust right into the shit. Like right into L.A. or SF, rather than adjusting or letting it sink in slowly. So, usually it’s pretty jarring for me just because the pace is a lot more relaxed and different here. Having a bit of that outside perspective now allows me to look at things a bit differently. (Landon Moblad)

GEOGRAPHER: EARTH PEOPLE

The dress code doesn’t include a finely-pressed lab coat, and the toolbox isn’t filled with fragile beakers, but a geographer is indeed a scientist, one who pours himself into the earth and bleeds across its surfaces to observe and categorize its residents. I haven’t asked the members of the San Francisco synth-pop trio Geographer if this occupation has had any inspiration on its sound, but there’s reason to believe the answer may be a humble yes.

Geographer has discovered new ground in the electronic realm. Its unique ménage a trois of music-making contraptions — drums, synth and cello — produces audible scenery that simultaneously calms and energizes the senses. Luscious forests of synth share habitats with rushing bass and guitar. The cello adds a sneaky-smooth layer that easily melts between or melds the more jagged sounds.

Behind the sweet scenery resides a less than pretty picture. Themes of loss and inevitable change creep through their sun-stained melodies, pulling at the roots of the band’s core. In 2005, Michael Deni fled his home in New Jersey, after the unexpected deaths of two family members. He landed in SF, and his instruments became a source of comfort and release while he wandered the new, unfamiliar territory. After a period of searching and surveying, Deni met and began collaborating with Nathan Blaz and Brian Ostreicher. In 2008, Geographer self-released its debut full-length, Innocent Ghosts, a far more relaxed collection that showcases Deni’s round, patient voice.

The landscapes on 2010’s Animal Shapes (Tricycle) are majestic, but far more celebratory. Things are tighter spun, beats kick harder and there’s a cohesive exploratory factor. Specifically fabulous: “Kites,” a track that strikes gold with a lustrous synth party. Deni’s sincere vocals float high above the mountainous bass vibrations, but mingle ever so courteously with the shrill, twinkling electronic additions. Enter the romantic cello and the song is a straight-up gem.

Now is a good time to button up your favorite white jacket and take some notes on the current environment in which you reside. Whether you’re into earth science or not, Geographer is a swell listen that goes well with salty pretzels and an adventure around your own neighborhood. Animal Shapes on repeat will keep you in step with eyes and ears open. And listen carefully: there’s good word on the street about these Geographer guys in the live form. (Amber Schadewald)

PSYCHIC FRIEND: PIANO POWER

Will Schwartz and the piano go way back, to when he was nine. “I’ve been attracted to the C chord and to A minor since I was a kid,” he says from L.A., where he’s living in Los Feliz. “I learned to play piano by ear, and it was always based on [starting with] a C major and going from there.”

You could say Schwartz played his first gigs on the instrument. “We had this two-story living room in our house in New Jersey with a little balcony, and the piano was up on the balcony,” he says with a laugh. “I would imagine I was playing for people down below. I would put on shows for the living room furniture.”

In his new band Psychic Friend, Schwartz updates California chamber or piano pop for today’s era, with contributions by Hole drummer Patty Schemel and instrumentalist-producer Bo Boddie. The result is a fresh chapter in Schwartz’s musical story, one that has ranged from the guitar-rock of Imperial Teen to the D.I.Y. choreographed pop of Hey Willpower, which involved contributions from videomaker Justin Kelly, DJ Chelsea Starr, and musician Tomo Yasuda.

Crisp and clean, in a way Psychic Friend sounds like the moment Schwartz has found his voice, or unknown heights or depths of it. The pounding “Once a Servant” revives the spirit of Jobriath. “Water Sign” has a Serge Gainsbourg undercurrent. “Shouldn’t Have Tried Again”‘s rendering of the repeat failure of a relationship matches the plaintive sunshine-y yearning of Harry Nilsson’s sublime covers of Randy Newman.

You could say Psychic Friend is new Californian pop. The piano-based melodic immediacy of the group’s sound has a kinship to Carole King’s solo work, or Burt Bacharach and some of his hits for psychic and other friends, yet both the sound and the lyrical content is very contemporary, not retro. It also isn’t Rufus Wainwright showboating — tracks like “We Do Not Belong” allow Schwartz’s voice a freedom and resonance it hasn’t had before, but he doesn’t run away with himself. “The nature of playing a piano and writing melodic songs, it almost brings you back to ’70s songwriting,” Schwartz observes.

“I just found this place in my voice that feels very connected, actually, that comes from playing the piano, and it feels good,” he adds, simply.

Schemel’s powerful drumming and Boddie’s hit-making skills have a role in this shift. “It’s like an Eddie and the Cruisers feeling,” Schwartz says, “where you start to play something, and by the end it sounds like a finished song.” (Huston)

Mayor Ed Lee willing to disclose work calendar

Among the many issues that rankled progressives under Mayor Gavin Newsom’s administration was Newsom’s unwillingness to turn over his work calendar to members of the public who formally requested it. Beginning in 2006, a group of sunshine activists routinely submitted public-information requests for the mayor’s daily schedule in hopes of finding out who Newsom was meeting with, what events he attended, and just how he spent his time on the job as mayor of San Francisco. After years of battle, Newsom finally agreed to release a watered-down calendar containing very little information.

On this matter, it does not seem as if Interim Mayor Ed Lee will follow in the footsteps of his predecessor.

In an interview with Guardian reporters today, Mayor Lee indicated that he would be willing to make his calendar available to the public. “Sure,” he said when we asked him about it. “I have no problem with that.”

Lee noted that he has complied with similar requests in the past. “I’ve had those already reviewed as the City Administrator, so I’m used to it,” Lee said.

He added that while he was willing to share his work-related calendar, “I may not want to share where I privately go every night.”

That’s OK. Thanks to former Mayor Willie Brown, we already know Lee went out to dinner in North Beach the other night with Brown, Rose Pak, and several others.

CHEAP EATS The things that New Orleans throws at you! Example: a wall of doors, so metaphoric it hurts. My goal is, for the length of this column, to not let it mean anything, just … a wall of doors. Yep.

So this wall of doors separates our yard here from the neighbor’s, which isn’t a yard so much as a couple of feet between houses, a walkway. And, instead of a picket fence, door door door door door. All wooden, all weathered to varying degrees and in different ways. A few still have their knobs on, and these sparkle in the sunshine — albeit meaninglessly. One has no knob, but yes hardware, which is rusty and does not sparkle.

Shine or no, each door is beautiful in its own way; some are bare, others getting there but with swaths of prehistoric primer still, or paint. One had been covered so thickly, so many times, in a now-yellowing white, that the cracks in it resemble giraffe skin. Another has window panes, four quarters: two still have glass, and two are blank space. I could pass a cold beer through to the workers working on the dilapidated house next door.

New Orleans is a ragged and broken city, which is of course part of its charm. The streets have potholes the size of swimming pools. The sidewalks end, drop off, bend and crack. I’m afraid to ride my bike. Walking is an extreme sport. The zoo is just across the street, and I take the Doughboy there because it is safe and smooth. We are becoming friends with the zookeepers, and already they have let us pet a snake.

End of the day, when I told his mummy about this snake-petting business, she wondered what my own personal “spirit animal” was.

“Giraffe,” I said, without even thinking about it. Before, as you know, it was chickens. Why — since I am famous for eating me my meat — do I always identify with the vegetarian, and the prey?

My new New Orleans friends, the human ones, are meat meat meat eaters, and music music music lovers, which makes perfect sense because food and tunes are what this town is all about. You can imagine my giddiness. Hedgehog, the one I am kissing, works on a TV show I’ve never seen, because I don’t have a TV, let alone HBO, so I feel especially qualified to give it an especially objective review. I mean, how much more objective can you be than to never have even seen a thing? So: not enough plot. Or character. Oodles of fantastic music.

I base this impression solely on comments made by my TV-having friends back home when I’ve mentioned that, yo, I’m hanging with someone from Treme. Then when I tell them that she does sound, then they are impressed.

On Monday, Hedgehog and me walked along the Mississippi River, drank vodka in a gay man bar, and ate at a place called Green Goddess, which (hee hee hee) is all about meat — pulled pork flapjack for me, and a bacon meatloaf samwich for her.

Mind you, that’s at the Green Goddess. So you can imagine what goes down at the restaurants called Butcher, and Pig — but in French, which here doesn’t mean pretentious. I’m in heaven!

Next evening, four of us gathered after work for $2 taco night and $2 Red Stripes at the Caribbean-influenced Rum House. Just some of the stuff my own personal tacos featured: lamb vindaloo, barbecued ribs, roasted duck, and goose cracklin. Um, that’s four different animals crammed into only three $2 tacos.

You know how after-work gatherings go: the televisionistas are unwindingly griping, their shitty day this, their shitty day that, and I’m just serenely sipping my Red Stripe because I’d had an awesome day, changing diapers.

Tomorrow we’re eating at Patois, and Sunday we’re having a little Super Bowl party. I’m making my patented barbecued eggs, and Hedgehog is bringing her patented gumbo tacos, and what the fuck? I can’t get me no lesbian love in queer central, San Francisco, where I’m popular. Or in Boston, where I rock. Whereas one week into New Orleans, where my most ardent admirers are a nine-month-old boy and a handful of zookeepers, and I’m squeezing me a hot hot hottie who’s won a goddamn Emma.

Or whatever that’s called. Bragging? Not really. I’m just looking out my window at a wall made of doors.

Dusting off the confetti and party debris that usually accompanies Black Moth Super Rainbow’s performances, Tobacco breaks from his so-called side project to take matters into his own smokin’ hot meat hooks and show off last year’s Maniac Meat and his freshest slab of sound, La Uti EP. It’s all bewitching stuff, even without the motor-mouthed rap by Aesop Rock that graced Tobacco’s debut Fucked Up Friends. These days matters are less manic though plenty witchy (“Fresh Hex,” featuring Beck) with beats that land as heavily as heck (“Sweatmother”). Hex, if the Butthole Surfers can luck into a hit, who’s to say that the Pittsburgh music meister won’t have the kids singing along to “Motorlicker” or “Lamborghini Meltdown” sometime soon? Cutting Ball Theater presents a reimagining of the myth of Ariadne, Theseus, and the Minotaur. Bone to Pick premiered in 2008 to critical acclaim, and now returns with its sequel, Diadem. Bone to Pick begins with Ariadne as a waitress in a diner — 3,000 years after being left on the island of Naxos, which now happens to be a deserted U.S. Army base. Diadem flashes back to the day Ariadne was left on Naxos by Theseus. Jamie Nova’s voice takes no prisoners. Bluesy and deep, gritty and unfaltering — think, “Black Velvet, If You Please” but without all the drama. It makes sense considering her years of practice in her other endeavor, the AC/DC tribute band Hells Belles, as Bon Scott-Brian Johnson. In the Seattle-based Witchburn, Nova’s strong vocals are a quintessential match for straightforward rock. Guitarist Mischa Kianne, who’s been hammering away metal riffs since junior high, is her six-string equivalent. With a debut album produced by Jack Endino, the man behind seemingly every good band from Nirvana to High on Fire, Witchburn is rock incarnate. (Kat Renz)

Two in the Wave and “Bringing Up Léaud: The Antoine Doinel Cycle”

Emmanuel Laurent chronicles the hugely influential French nouvelle vague through the lives of its flagship auteurs in Two in the Wave. Raised in hardscrabble poverty, Francois Truffaut made films that reflected an increasingly sentimental yearning for the middle class. Jean-Luc Godard was raised in Swiss bourgeois comfort — yet he gravitated toward a Marxist proletarianism perversely avant-garde in the extreme. Both shared (and fought over) onscreen muse Jean-Pierre Léaud, plucked from Parisian streets to star in Truffaut’s 1959 The 400 Blows. One might reasonably conclude from evidence here that Truffaut, dead from a brain tumor in 1984, was the greater artist — or at least humanitarian. Yet coldly intellectual, ever-more-bilious Godard continues into his 80s, last year’s abstract Film Socialisme restoring him to rarefied critical if not popular favor. This dual portrait reaches an ingratiating zenith toward its end, when we see surviving interviewee Léaud growing up onscreen, anxious to please twin mentors. The Roxie’s weeklong showcase is double-billed with all five films in which the actor played Truffaut alter ego Antoine Doinel, from Blows to 1979’s Love on the Run. (Dennis Harvey)

“Jersey Score”

It’s not enough that the Situation, Ronnie, and Vinny graced a certain New York alt weekly’s 2010 Queer Issue cover. It’s not enough that Snooki’s novel, A Shore Thing, could be read as an homage to Truman Capote’s Answered Prayers. (Sample line: “She could pour a shot of tequila down his belly and slurp it out of his navel without getting splashed in the face.”) Nor is it sufficient that the gay community has enough G.T.L. freaks — call them gaydos — to fill a million grenade-filled hot tubs. No, now we must celebrate Jersey Shore‘s beachy meatballs with a one-off party dedicated to “tanned-up muscle boys and fist-pumping homos that are D.T.F.” Exuberant promoter Joshua J.’s shindigs are equal parts irony and earnestness, which in this case basically equals frickle bombs no matter how you slice it. Juan MacLean DJ set

“The” Juan MacLean, club cornerstone of heralded New York City dance punk label DFA: that affiliation goes back to Six Finger Satellite, the band in which MacLean (at that time John) played guitar and future LCD Soundsystem mastermind James Murphy produced material and ear-drum destroying live setups. Since then MacLean has transitioned to creating steady dance grooves, where drums hit hard and fast atop a background of melancholy melodies, uncompressed and rarely distorted. Lee should stop the recycling eviction

EDITORIAL Mayor Ed Lee needs to demonstrate, as we noted last week, that he’s making a clean break from the politics and policies of the Newsom administration — and there are things he can do immediately to reassure San Franciscans that he’s going to offer more than another 11 months of a failed administration.

He can start by calling off the eviction of the Haight Ashbury Neighborhood Recycling Center.

The move by Newsom to evict the recycling center, on the edge of Golden Gate Park, was part of his administration’s war on the poor. It made no sense from a financial or environmental perspective. The center, which pays rent to the city, would be replaced by a community garden, which would pay nothing. The center creates green jobs that pay a living wage; all the workers would be laid off under Newsom’s plan. The center also operates a native plant nursery and provides a drop-off recycling site for local businesses.

A community garden makes only limited sense in a shady area that gets fog most of the year.

The only reason Newsom was determined to get rid of the place is that low-income people who collect bottles and cans around the city (an environmentally positive activity, by the way) come by the center to drop them off and pick up a little cash. Some of the wealthier residents of the Haight don’t like poor people wandering through their neighborhood. It’s class warfare, declared by the Newsom administration — and Lee, who got his start as a poverty lawyer, doesn’t have to tolerate it.

Lee should direct the Recreation and Parks Department to cease the eviction proceedings and negotiate a long-term lease for the Frederick Street site.

It seems like a small item in the long list of issues the new mayor will have to deal with — but the HANC recycling center has strong symbolic importance. Ending the eviction and allowing the center to stay would be a sign that Lee intends to be a mayor who is willing to work with the progressives and that he’s not going to try to solve all the city’s problems by blaming, harassing, and criminalizing people who are barely surviving in San Francisco.

The new mayor could take another simple step toward broad credibility by opening up his office — to the public and the press. Under Newsom, Room 200 was an unfriendly place to outsiders, and often the news media were treated as enemies. Lee should start holding regular press conferences — not just stage-managed events designed to showcase one issue, but broad-ranging, open sessions where reporters can ask questions about anything his administration is doing. And he ought to direct his press office to make compliance with the Sunshine Ordinance a priority.

For starters, he could release whatever proposed budget cuts Newsom left behind. It’s hard to believe the former mayor just turned them over to Lee without a list of things that were on the chopping block. The sooner the public sees where the previous administration was going, the sooner we can all determine what, if anything, Lee will do differently.

You can argue about what the word “progressive” means, and you can argue about the process and the politics that put Ed Lee in the Mayor’s Office. And you can talk forever about which group or faction has how much of a majority on the San Francisco Board of Supervisors, but you have to admit: this city has just undergone a significant political realignment.

Some of that was inevitable. The last members of the class of 2000, the supervisors who were elected in a rebellion against the sleaze, corruption, and runaway development policies of the Willie Brown administration, have left office. Gavin Newsom, the mayor who was often at war with the board and who encouraged a spirit of rancor and partisanship, is finally off to Sacramento. For the first time since 1978, the supervisors will be working with a mayor they chose themselves.

For much of the past 15 years, progressive politics was as much about stopping bad things — preventing Brown and then Newsom from wrecking the city — as it was about promoting good things. But the “politics of anti,” as San Francisco State political scientist Rich DeLeon describes is, wasn’t a central theme in the November elections, and this generation of supervisors comes into office with a different agenda.

Besides, one of the clear divisions on the board the past seven years was the Newsom allies against the progressives — something that dissipated instantly when Lee took over.

But the realignment goes deeper.

Until recently, the progressives on the board had a working majority — a caucus, so to speak — and they tended to vote together much of the time. The lines on the board were drawn almost entirely by what Newsom disparagingly calls ideology but could more accurately be described as a shared set of political values, a shared urban agenda.

There are still six supervisors who call themselves progressives, but the idea that they’ll stick together was shattered in the battle over a new mayor — and the notion that there’s anything like a progressive caucus died with Board President David Chiu’s election (his majority came in part from the conservative side, with three progressives opposing him) and with Chiu’s new committee assignments, which for the first time in a decade put control of key assignments in the hands of the fiscal conservatives.

 

A PROGRESSIVE MAJORITY?

The progressive bloc on the board was never monolithic. There were always disagreements and fractures. And, thanks to the Brown Act, the progressives don’t actually meet outside of the formal board sessions. But it was fair and accurate to say that, most of the time, the six members of the board majority functioned almost as a political party, working together on issues and counting on each other for key votes. There was, for example, a dispute two years ago over the board presidency — but in the end, Chiu was elected with exactly six votes, all from the progressive majority that came together in the end.

That all started to fall apart the minute the board was faced with the prospect of choosing a new mayor. For one thing, the progressives couldn’t agree on a strategy — should they look for someone who would seek reelection in November, or try to find an acceptable interim mayor? The rules that barred supervisors from voting for themselves made it more tricky; six votes were not enough to elect any of the existing members. And, not surprisingly, some of the progressives had mayoral ambitions themselves.

When state Assemblymember Tom Ammiano — who would have had six votes easily — took himself out of the running, there was no other obvious progressive candidate. And with no other obvious candidate, and little opportunity for open discussion, the progressives couldn’t come to an agreement.

But by the Jan. 4 board meeting, five of the six had coalesced around Sheriff Mike Hennessey. Chiu, however, was supporting Ed Lee, someone he had known and worked with in the Asian community and whom he considered a progressive candidate. And once it became clear that Lee was headed toward victory, Sup. Eric Mar announced that he, too, would be in Lee’s camp.

A few days later, when the new board convened to choose a president, the progressive solidarity was gone. Sups. David Campos, John Avalos, and Ross Mirkarimi, now the solid left wing of the board, voted for Avalos. Chiu won with the support of Mar, Sup. Jane Kim, and the moderate-to-conservative flank.

Now the Budget Committee — long controlled by a progressive chair and a progressive majority — will be led by Carmen Chu, who is among the most fiscally conservative board members. The Land Use and Development Committee will be chaired by Mar, but two of the three members are from the moderate side. Same goes for Rules, where Sup. Sean Elsbernd, for years the most conservative board member, will work with ideological ally Sup. Mark Farrell on confirming mayoral appointments, redrawing supervisorial districts, and promoting or blocking charter amendments as Kim, the chair, does her best to contain the damage.

You can argue that having independent-minded supervisors who don’t vote as a caucus is a good thing. You can also argue that a fractured left will never win against a united downtown. And both arguments have merit.

But you can’t argue any more that the board has the same sort of progressive majority it’s had for the past 10 years. That’s over. It’s a new — and different — political era.

What happens now? Will the progressives hold enough votes to have an influence on the city budget (and ensure that the deficit solutions include new revenue and not just cuts)? What legislative priorities will the supervisors be pushing in the next year? How will the votes shake out on difficult new proposals (and ongoing issues like community choice aggregation)?

Mayor Lee has pledged to work with the board and will show up for monthly questions. How will he respond to the sorts of progressive legislation — like tenant protections, transit-first policies, immigrant rights measures, and stronger affordable housing standards — that Newsom routinely vetoed?

How will this all play out in a year when the city will also be electing a new mayor?

 

IDENTITY POLITICS?

When Sups. Chiu, Mar, and Kim broke with their three progressive colleagues to support Chiu for board president — just as Chiu and Mar helped clear the path for Ed Lee to become mayor days earlier — it seemed to many political observers that identity had trumped ideology on the board. There’s some truth to that observation, but it’s too simple an explanation. There’s also the fact that Chiu strongly supported Kim, who is a personal friend and former roommate, in her election, so it’s no surprise she went with him for board president.

And the phrase itself is so laden with baggage and problems that it’s hard to talk about. It has come to signify a wide range of political activity and theorizing founded in the shared experiences of injustice of members of certain social groups. “Rather than organizing solely around belief systems, programmatic manifestoes, or party affiliation, identity political formations typically aim to secure the political freedom of a specific constituency marginalized within its larger context,” says the Stanford Encyclopedia of Philosophy, an ongoing research project by the students and faculty at Stanford University.

Although the notion of identity politics took hold during the social movements of the 1960s and ’70s — when liberation and organizing movements among women and various ethic and other identity groups fed a larger liberal democratic surge that targeted war, economic inequity, social injustice, and other issues — it’s also a political approach that has divided the populace.

“One of the central charges against identity politics by liberals, among others, has been its alleged reliance on notions of sameness to justify political mobilization,” says the Stanford Encyclopedia. “Looking for people who are like you rather than who share your political values as allies runs the risk of sidelining critical political analysis of complex social locations and ghettoizing members of social groups as the only persons capable of making or understanding claims to justice.”

Mar explains that the reality of identity politics and whether it’s a factor in the current politics at City Hall is far more complex.

“With me, David Chiu, and Jane Kim as a block of three progressive Asians — and I still define David Chiu as a progressive though I think some are questioning that — we all come out of what I would call a pro-housing justice, transit-first, and environmental sustainability [mindset],” Mar told us. “But I think because of our ethnic background and experiences, we may have different perspectives at times than other progressives.”

For example, Mar said, many working class families of color need to drive a car so they’ll differ from progressives who want to limit parking spaces to discourage driving. He also has reservations about the proposed congestion pricing fee and how it might affect low-income drivers.\

“I think often when progressive people of color come into office — Jane Kim might be one of the best examples — that sometimes there’s an assumption that her issues are going to be the same as a white progressive or a Latino progressive,” he said. “But I think kind of the different identities that we all have mean that we’re more complex.”

Campos, a Latino immigrant who is openly gay, noted that “as a progressive person of color, I have at times felt that the progressive movement didn’t recognize the importance of identity politics and what it means for me to have another person of color in power.”

But, he added, “I don’t think identity politics alone should guide what happens. A progressive agenda isn’t just about race but class, sexual orientation, and other things. It’s not enough to say that identity politics justifies everything.”

University of San Francisco political science professor Corey Cook told the Guardian that identity has always been a strong factor in San Francisco politics, even if it was overshadowed by the political realignment around progressive ideology that occurred in 2000, mostly as a reaction to an economic agenda based on rapid development and political cronyism.

“I’m not sure that identity wasn’t relevant, but it was swamped by ideology,” Cook told the Guardian. Now, he said, another political realignment seems to be occurring, one that downplays ideology compared to the position it has held for the last 10 years. “I’m not sure that ideology is dead. But the dynamics have definitely changed.”

Cook sees what may be a more important change reflected in Chiu’s decision to put the political moderates in control of key board committees. But he said that shift was probably inevitable given the difficulties of unifying the diverse progressive constituencies.

“It’s hard to hold a progressive coalition together, and it’s amazing that it has lasted this long,” he said.

There’s another kind of identity politics at play as well — that of native San Franciscans, who often express resentment at progressive newcomers talking about what kind of city this is, versus those who see San Francisco as a city of immigrants and ideas, a place being shaped by a wider constituency than the old-timers like to acknowledge.

“I’m honored to join Sups. Elsbernd and Cohen in representing the neighborhoods they grew up in,” Sup. Mark Farrell said during his opening remarks after being sworn in Jan. 8., sobbing when he thanked his parents for their support.

As he continued, he fed the criticism of the notion of ideology-based politics that has been a popular trope with Gavin Newsom and other fiscal conservatives in recent years, telling the crowd he wanted “to turn City Hall into a place based on issues and ideas, not ideology.”

Cohen also placed more importance on her birthright than on her political philosophy, telling stories about entering board chambers through the back door at age 16 when she was part of a youth program created by then-Mayor Frank Jordan, and with former Mayor Dianne Feinstein coming to speak at Cohen’s third-grade class. “I am a San Francisco native, and that is a responsibility I take seriously,” said Cohen, who graduated from the Emerge Program, which grooms women for political office,

“We will have another woman as president of the Board of Supervisors, and we will have a woman as mayor of San Francisco,” she added. And as the sole African American on the board, she also pledged, “I will be working to add more members of the African American community to the elected family of San Francisco.”

But what issues she plans to focus on and what values she’ll represent were unclear in her comments — as they were throughout her campaign, despite the efforts of journalists and activists to discern her political philosophy. In her public comments, her only stated goal was to build bridges between the community and City Hall and let decisions be guided by the people “not political ideologies.”

Oftentimes in recent San Francisco history, identity and ideology have worked in concert, as they did with former Sup. Harvey Milk, who broke barriers as the first openly gay elected official, but who also championed a broad progressive agenda that included tenants rights, protecting civil liberties, and creating more parks and public spaces.

Sup. Scott Wiener, shortly after being sworn into office, acknowledged the legacy of his district, which was once represented by Milk and fellow gay progressive leader Harry Britt, telling the crowd: “I’m keenly aware of the leadership that has come through this district and I have huge shoes to fill.”

Yet Wiener, a moderate, comes from a different ideological camp than Milk and Britt and he echoed the board’s new mantra of collaboration and compromise. “I will always try to find common ground. There is always common ground,” he said.

 

GETTING THINGS DONE?

Chiu is making a clear effort to break with the past, and has been critical of some progressive leaders. “I think it’s important that we do not have a small group of progressive leaders who are dictating to the rest of the progressive community what is progressive,” he said.

While he didn’t single out former Sup. Chris Daly by name, he does seem to be trying to repudiate Daly’s leadership style. “I think that while the progressive left and the progressive community leaders have had very significant accomplishments over the past 10 years, I do think that there are many times when our oppositional tactics have set us back.”

When Chiu was reelected board president, he told the crowd that “none of us were voted into office to take positions. We were voted into office to get things done.”

Some progressives were not at all happy with that comment. “I thought that was a terrible thing to say,” Avalos told the Guardian, arguing the positions that elected officials take shape the legislation that follows. As an example, he cited the positions that progressive members of Congress took in favor of the public option during the health care reform debate.

Talking about getting things done is “a sanctimonious talking point that fits well with what the Chronicle and big papers want to hear,” Avalos said. He said the Chronicle and other downtown interests are more interested in preserving the status quo and blocking progressive reforms. “It’s what they want to see not get done.”

Campos even challenged the comment publicly during the Jan. 11 board meeting when he said, “It’s important to get things done, but I don’t think getting things done is enough. We have to ask ourselves: what is it that we’re getting done? How is it that we’re getting things done? And for whom is it that we’re doing what we’re doing? Is it for the people, or the downtown corporate interests? I hope it’s not getting things done behind closed doors.”

Chiu said that, for him, getting things done is about expanding the progressive movement and consolidating its recent gains. “I think we all share a political goal. As progressives, we all share a political goal of getting things done and growing mainstream support for our shared progressive principles so that they really become the values of our entire city.”

To do that, he said, progressives are going to need to be more conciliatory and cooperative than they’ve been in the past. “I think it’s easy to slip into a more oppositional way of discussing progressive values, but I’m really pushing to move beyond that.”

The biggest single issue this spring will be the budget — and it’s hard to know exactly where the board president will draw his lines. “I have spoken to Mayor Lee about the need for open, transparent, and community-based budget processes and he’s open to that,” Chiu told us — and that alone would be a huge change. But the key progressive priority for the spring will be finding ways to avoid brutal budget cuts — and that means looking for new revenue.

When asked whether new general revenue will be a part of the budget solution, instead of Newsom’s Republican-style cuts-only approaches, Chiu was cautious. “I am open to considering revenues as part of the overall set of solutions to close the budget deficit,” he said. “I am willing to be one elected here that will try to make that argument.” But with his political clout and connections right now, he can do a lot more than be one person making an argument.

Chiu has always been open to new revenue solutions and even led the way in challenging the cuts-only approach to both the city budget and MTA budget two years in a row, only to back down in the end and cut a deal with Newsom. When asked whether things will be better this year given his closer relationship to Lee, Chiu replied, “I think things are going to be different in the coming months.”

During the board’s Jan. 7 deliberation on Lee, Sup. Eric Mar also said that based on his communications with Lee, Mar believed that the Mayor’s Office is open to supporting new revenue measures. He echoed the point later to us.

In addition to supporting the open, inclusive budget process, Mar called for “a humane budget that protects the safety net and services to the most vulnerable people in San Francisco is kind of the critical, top priority.

“I think it’s going to be difficult working with the different forces in the budget process,” he added. “That’s why I wish it could have been a progressive who was chairing the budget process.”

Mar said progressive activism on the budget process is needed now more than ever. “The Budget Justice Coalition from last year I think has to be reenergized so that so many groups are not competing for their own piece of the pie, but that it’s more of a for-all, share-the-pain budget with as many people communicating from outside as possible, putting the pressure on the mayor and the board to make sure that the critical safety net’s protected.”

 

CUTS WILL BE CENTER STAGE

But major cuts — and the issue of city employees pay and benefits — will also be center stage.

At the board’s Jan. 11 meeting, before the supervisors voted unanimously to nominate Lee as interim mayor, Sup. Elsbernd signaled that city workers’ retirement and health benefits will once again be at the center of the fight to balance the budget.

Elsbernd noted that in past years he was accused of exaggerating the negative impacts that city employees’ benefits have on the city’s budget. “But rather than being inflated, they were deflated,” Elsbernd said, noting that benefits will soon consume 18.14 percent of payroll and will account for 26 percent in three years.

“Does the budget deficit include this amount?” he asked.

And at the after-party that followed Lee’s swearing-in, Public Defender Jeff Adachi, who caused a furor last fall when he launched the ill-considered Measure B, which sought to reform workers’ benefits packages, told us he is not one to give up lightly.

“We learned a lot from that,” Adachi said. “This is still the huge elephant in City Hall. The city’s pension liability just went up another 1 percent, which is another $30 million”

Chu agreed that worker benefits would be a central part of the budget-balancing debate. “Any conversation about the long-term future of San Francisco’s budget has to look at the reality of where the bulk of our spending is,” she said.

Avalos noted that he plans to talk to labor and community based organizations about ways to increase city revenue. “I’m going to work behind the scene on the budget to make sure the communities are well-spoken for,” Avalos said, later adding, “But it’s hard, given that we need a two-thirds majority to pass stuff on the ballot.”

Last year, Avalos helped put two measures on the ballot to increase revenue: Prop. J, which sought to close loopholes in the city’s current hotel tax and asked visitors to pay a slightly higher hotel tax (about $3 a night) for three years, and Prop. N, the real property transfer tax that slightly increased the tax charged by the city on the sale of property worth more than $5 million.

Prop. N should raise $45 million, Avalos said. “I’ve always had my sights set on raising revenue, but making cuts is inevitable.”

 

THE IDEOLOGY ARGUMENT

Newsom and his allies loved to use “ideology” as a term of disparagement, a way to paint progressives as crazies driven by some sort of Commie-plot secret agenda. But there’s nothing wrong with ideology; Newsom’s fiscal conservative stance and his vow not to raise taxes were ideologies, too. The moderate positions some of the more centrist board members take stem from a basic ideology. Wiener, for example, told us that he thinks that in tough economic times, local government should do less but do it better. That’s a clear, consistent ideology.

For much of the past decade, the defining characteristic of the progressives on the board has been a loosely shared urban ideology supported by tenants, immigrant-rights groups, queer and labor activists, environmentalists, preservationists, supporters of public power and sunshine and foes of big corporate consolidation and economic power. Diversity and inclusiveness was part of that ideology, but it went beyond any one political interest or identity group.

It was often about fighting — against corruption and big-business hegemony and for economic and social equality. The progressive agenda started from the position that city government under Brown and Newsom had been going in the wrong direction and that substantive change was necessary. And sometimes, up against powerful mayors and their well-heeled backers, being polite and accommodating and seeking common ground didn’t work.

As outgoing Sup. Daly put it at his final meeting: “I’ve seen go-along to get along. If you want to do more than that, if you think there’s a fundamental problem with the way things are in this world, then go-along to get along doesn’t do it.” When Chiu announced that the new progressive politics is one of pragmatism, he was making a break from that ideology. He was signaling a different kind of politics. He has urged us to be optimistic about the new year — but we still don’t know what the new agenda will look like, how it will be defined, or at what point Chiu and his allies will say they’ve compromised and reached out enough and are ready to take a strong, even oppositional, stand. We do know the outcome will affect the lives of a lot of San Franciscans. And when the budget decisions start rolling down the pike, the political lines will be drawn fairly clearly. Because reaching across the aisle and working together sounds great in theory — but in practice, there is nothing even resembling a consensus on the board about how the city’s most serious problems should be resolved. And there are some ugly battles ahead.

The sooner the public sees where the previous administration was going, the sooner we can all determine what, if anything, Lee will do differently.

Sam Love and I rented a camper van and decided it would be our home for the next three weeks, as we made our way loop-dee-loop around the south island of New Zealand. A few hours in, we realized that there aren’t that many people in New Zealand (but tons of sheep!) and townships are quite spread out, resulting in very few radio stations.

This was a problem. We planned on driving, like hundreds of miles. But with no music? No way. No how! As we pulled into Queenstown, we had a mission. A thrift store needed to be found – CDs needed to be purchased. And there it was, the Salvation Army (or Sallie’s as they like to call it there). They did have CDs … and guess what? They were ALL Willie Nelson. Every-single-one. So we got one titled “Willie Stripped” which includes a CD booklet with photos of Willie sitting naked in the bath. Bonus! So now, when I think of New Zealand, I think of Willie Nelson, Sam Love and me belting out “Bring Me Sunshine” as we chugged in our little van through the mind blowing landscape of the Fiordland National Park.

So seeing Willie last night, live at the Fillmore, was like a triple/quadruple bonus. This man is an icon, who stands for peace, love and tons of free flowing whiskey. And even though he is such an American symbol, Willie Nelson will forever remind me of that New Zealand roadtrip.

The agenda for Mayor Lee

EDITORIAL San Francisco has its first Chinese American mayor, and that’s a major, historic milestone. Let’s remember: Chinese immigrants were among the most abused and marginalized communities in the early days of San Francisco. In 1870, the city passed a series of laws limiting the rights of Chinese people to work and live in large parts of the city. Chinese workers built much of the Transcontinental Railroad — at slave wages and in desperately unsafe conditions that led to a large number of deaths. The United States didn’t even repeal the Chinese Exclusion Act (an anti-immigration law) until 1943, and for years, Chinatown was one of the poorest and most neglected city neighborhoods.

So there’s good reason for Asians to celebrate that the last door in San Francisco political power is now open. And Mayor Ed Lee comes from a civil rights background; he got his start in politics working as a poverty lawyer and tenant organizer.

Unfortunately, his path to Room 200 was badly marred by some ugly backroom dealing involving Willie Brown, the most corrupt mayor in modern San Francisco history. Even Lee’s supporters agree the process was a mess and that it undermines Lee’s credibility. So it’s important for Mayor Lee to immediately establish that he’s independent of Brown and his cronies, that his administration will not just be a Gavin Newsom rerun, and that progressives can and should support him.

He has a tough job ahead. We urge him to make a clean break with the past and set the city in a new direction. Here are a few ways to get started.

Clear out the Newsom operatives and bring some new people with progressive credentials into the senior ranks. Newsom’s chief of staff, Steve Kawa, has been a shadow mayor for the past year while Newsom was on the campaign trail, and is the architect of much of what the outgoing administration has done to sow political division and cripple city government. Lee needs his own chief advisor.

Show up for question time and work with the district-elected supervisors. Newsom was openly dismissive of the board and refused to take the supervisors seriously as partners in city government. Lee should appear once a month to answer questions from the board in public, should meet regularly with all the supervisors and appoint a liaison that the board can work with and trust. He needs to make his administration as transparent and open as possible and ensure that everyone at City Hall follows the letter and spirit of the Sunshine Ordinance.

Make it clear that the next city budget includes substantial new revenue. Newsom offered nothing but Republican politics when it came to city finance; his only solutions to the massive structural deficit involved service cuts.

The deficit will be even worse than projected this year, since Gov. Jerry Brown wants to transfer much of the state’s responsibility for public safety and public health back to local government — and there won’t be enough state money attached to handle the new burden. Lee needs to publicly call on Brown and the Legislature to give cities more ability to raise taxes on the local levee. Then he should start planning for a June ballot package that will raise as much as $250 million in new revenue for the city.

A substantially higher vehicle license fee on expensive cars, a congestion management fee, a significant annual transit impact fee on downtown offices, a restructured business tax, and a progressive tax on income of more than $50,000 a year would more than eliminate the structural deficit.

There are plenty of other revenue ideas out there; not all can or would pass on a single ballot. But Lee needs to make it clear that revenue will be part of the solution — and that he will use all the political capital he can muster to convince the voters to go along.

<\!s> Get serious about community choice aggregation. Newsom loved to talk about his environmental agenda, but when it came to challenging the hegemony of Pacific Gas and Electric Co. and its dirty power portfolio, he ran for cover. His hand-picked Public Utilities Commission director, Ed Harrington, has been an obstacle to implementing the city’s CCA plan. Lee needs to get rid of Harrington or direct him to cooperate with the supervisors and get San Francisco on the path to clean public power.

<\!s> Establish a real affordable housing program. The city plans to build housing for as many as 60,000 new residents in the southeast neighborhoods — but only a fraction of them will be affordable. This city is already well on its way to becoming a high-end bedroom community for Silicon Valley; only a clear policy that limits new market-rate condos until there’s a plan for adequate affordable housing will turn things around.

<\!s> Support Sanctuary City and quit helping federal immigration authorities break up families. Newsom was just awful on this issue; Lee needs to work with Sup. David Campos to implement more humane laws.

<\!s> End the demonization of homeless people and public employees. Newsom came to power attacking the homeless (with Care Not Cash) and went out attacking the homeless (with the sit-lie law). Lee ought to tell the Police Department not to aggressively enforce the ordinance.

<\!s> Take on the sacred cows of the Police and Fire departments. The biggest salary and pension problems in the city are in the two public safety departments. The Fire Department budget has been bloated for years. If everyone else is taking cuts, so should the highest-paid cops and the overstaffed fire stations.

Some of Lee’s supporters insist he’s a solid progressive and that we shouldn’t hold the details of his selection — or the fact that he was chosen by people who are openly hostile to the progressive agenda — against him. We’re open to that — but the progressive community will judge him on his record. And he has to start right away.

Baby daddy drama

YEAR IN FILM Who’s your daddy? That tired line was more relevant ever in 2010, as big screens saw a firming trend in sperm-donor comedies. These films have attacked so-called family values from a much more commonplace front. After all, artificial insemination is an everyday occurrence. Thousands of multiple births happen in this country every year — according to the Centers for Disease Control and Prevention, there were almost 6,000 triplet births in 2007 — for mothers who are increasingly older and unmarried, and a good many of the multiples result from assisted reproductive therapies such as artificial insemination.

Many a hand has been wrung, historically, over the impact of childbearing among unmarried women: the CDC report’s author cites concerns about family structure and the economic security of children, stating that single moms have more limited financial resources than married breeders. But then what to make of such 2010 comedies as The Kids Are All Right, The Switch, and The Back-up Plan? — not to mention the small-screen tabloid shenanigans of Octomom and the arti-insem antics of the Gosselin family?

Coming on the heels of Baby Mama (2008), which saw two women surmounting class barriers to bond over surrogacy, and welfare-sploitation drama Precious (2009), which included possibly the most nightmarish single mom ever, 2010’s unmarried, artificially inseminated cinematic moms tellingly embody the idea of choice — though the repercussions of their decision to have a child by either an unnamed baby daddy or a known, accomplished stud donor, are still considered the stuff of laughs, both realistic and aspirational.

While The Back-Up Plan rings as the most by-the-book, tepid rom-com of the lot and The Switch feels like a curveball, focusing more on Jason Bateman’s drunken DNA switcheroo and his resulting sad-faced and neurotic offspring (implying a kind of ambivalence about artificial insemination), the best of the bunch is The Kids Are All Right. Grounded and realistic, the dramedy is confident enough to leave a few loose ends dangling, to give the power to the fruit of those supposedly unnatural unions. Just one teensy step beyond gay marriage, gay parenting in The Kids Are All Right is normative, even bourgeois, with one mom, Nic (Annette Bening), working as a doctor and the other, Jules (Julianne Moore), a stay-at-home searching for herself.

As open-minded as the narrator of the Who song that gives the film its title, kids Joni (Mia Wasikowska) and Laser (Josh Hutcherson) are piecing out their identities, in part by independently searching out their biological donor dad Paul (Mark Ruffalo), in part by making some very adult decisions about whether they want to have a relationship with him and whether they can trust him. Eons away from the classic messed-up single-mom offspring, Joni and Laser turn out to be more psychologically on-point and morally centered than their moms or bio pop Paul, a feckless Peter Pan charmer ready to jump into the family that life has presented him but irresponsible and thoughtless when it comes to embarking on an affair with Jules.

The painfully transparent, slowly-evolving hurt look on Nic’s face when she realizes the two are sexually involved turns our sympathies around to the side of the mom saddled with the bad cop-disciplinarian role, the uptight one seemingly at odds with the kickback California sunshine. A recent bitter, real-life custody battle between a U.K. lesbian couple and their sperm donor hasn’t sorted out quite so well. Family apparently has its limits — and its moments of forgiveness. The 1970s and ’80s TV and musical clans — à la the bunches Brady, Partridge, and Osmond — may have pushed a semi-subtextual message about togetherness in the face of social and generational upheaval, but these women and their kids are still working it out as they go.

FILM You had to forgive most of the gay press for getting a little too excited over Brokeback Mountain (2005). Oh, no doubt it’s a great movie, or that the Oscar going to the fraudulent Crash (2004) said less about that film’s virtues than a skittishness that other movie stirred. But its excellence and commercial success induced widespread bouts of wishful thinking in the form of announcing new trends that never came to pass.

Five years later, there hasn’t been another mainstream American film in which a gay relationship is taken seriously and granted central importance. (You could argue for The Kids Are All Right, but that’s mostly a comedy, a big arthouse hit rather than even a modest mainstream one — and the fact remains that lesbians played by attractive actresses aren’t nearly as threatening to the sanity, morality, masculinity, and private parts of many Americans as gay men.) Nor has a single major movie star come out as gay or bi, despite the hilarity induced by excuses for such police-intervention activities as “offering a ride” to transgender sex workers at 4 a.m. or getting mugged while “walking the dog” in a well-known cruising park (also at 4 a.m.). In all these regards, television has leapt well ahead of the big screen.

Given typically imitation-crazed Hollywood’s failure to built on Brokeback‘s success — or see it as anything more than a fluke — the case of I Love You Phillip Morris is interesting for what it is and isn’t. It is, somewhat by default, the biggest onscreen gay romance (not including foreign and indie productions, which are always ahead of the curve) since that earlier film, even if it is (again) primarily a comedy, and one whose true-story basis provides the leavening element of stranger-than-fiction curiosity. (Nobody’s bothered by the gayness of movies like 2005’s Capote because we accept the otherness of real people too famous and/or peculiar to be relatable.)

What Phillip Morris is not, however, is a Hollywood or even American film, all appearances to the contrary. Its financing was primarily French — presumably because there wasn’t enough willing coin on this side of the Atlantic. Yes, not even for a comedy starring Jim Carrey. And for a while it didn’t even look like Phillip Morris would be an American release, even after it had played (and done pretty well) virtually everywhere else, from Europe to Latin America to Southeast Asia to frikkin’ Kazakhstan. The reasons (some legal) are unclear, but it seems pretty certain the aforementioned squeamishness around guys kissing and cuddling and diddling factored in — never mind that those guys are Carrey and Ewan McGregor.

Free at last, albeit without much fanfare, Phillip Morris proves to have a whole lot more in common with Steven Soderburgh’s The Informant! (2009) — true tale turned farcical caper, to diverting if mixed results — than to tragic Brokeback, even if love runs a rather sad, thwarted course here, too. We meet Steven Jay Russell as an uber-perky all-American lad — a nascent Jim Carrey — perhaps permanently warped at age eight by the discovery that he’s adopted. Nonetheless he proceeds along the road of dead-center normality, getting married (Leslie Mann manages to be both very droll and very Christian as Debbie), having kids, being a loveable Mr. Policeman, and fucking guys only on the QT.

A near-fatal accident, however, induces him to merrily chuck it all — he’s so nice the family can’t help wishing him well — and live life to the fullest by moving from Georgia to South Beach and becoming a “big fag.” He soon discovers that “being gay is really expensive,” or at least his chosen A-lister lifestyle is. Having been schooled by his adoption trauma, Steve figures if everything you think you know can so easily turn out to be a lie, why not becoming a fibbing superstar? He begins diverting funds from his corporate employer, amazed at what a chief financial officer position and a golf-playing, polo-shirt-wearing front can get away with. At least to a point — the point that commences several ensuing revolving-door years of cons, captures, prison stints, and ingenious escapes.

It is during one hoosegow stay that he meets the non-tobacco-related Phillip Morris (McGregor), a sweet Southern sissy who got there by sheer haplessness rather than criminal guile. Steven is an ardent, protective lover — if he’s also slippery as an eel, that’s at least partly because he thinks his lies protect those he loves — and Phillip is a slavishly adoring 1950s housewife who just happens to have been born with a penis.

Like The Informant!, Phillip Morris fudges the facts a bit for narrative convenience and strains at times for an antic tone that makes life itself a sort of genre parody. In his genius-IQ mind, does Russell see himself as the hero of a perfect if artificial sitcom-type world? Or does casting Carrey require the same sort of hyperreal gloss routinely applied to gimmick-driven vehicles like Yes Man (2008), Bruce Almighty (2003), and Liar Liar (1997), because he bends any context like a funhouse mirror? (Only once, in 1998’s The Truman Show, did that context meaningfully amplify his cartoonishness; and only once, in 2004’s Eternal Sunshine of the Spotless Mind, has he calmed down to ordinary human proportions.) Glenn Ficarra and John Requa, making their directorial debut after team-writing a bewildering trio of mainstream comedies (2001’s Cats and Dogs, 2003’s Bad Santa, and 2005’s The Bad News Bears), approach their fascinating material with brashness and some skill, but without the control to balance its steep tonal shifts.

Surprisingly, it’s in the “love” part that they often succeed best. While their comic aspects sometimes tip into shrill, destabilizing caricature — the excess that brilliant but barely-manageable Carrey will always drift toward unless tightly leashed — this movie’s link to Brokeback is that it never makes the love between two men look inherently ridiculous, as nearly all mainstream comedies now do to get a cheap throwaway laugh or three.

Russell’s scenes with AIDS-fallen first boyfriend Jimmy (Rodrigo Santoro) are very poignant. And the many more with McGregor, who plays white-trash nelly with an uncondescending delicacy that’s both amusing and wistful, are quite lovely. There’s one scene of them chatting in their prison cell — viewed overhead in bed, Phillip’s head in the crook of Steven’s arm — that’s so affectionately intimate you can see exactly why the movie took two years to get a U.S. release. Even the prior scene of Carrey riding a different man’s ass like a bucking bronco isn’t as half so threatening as this, an utterly unguarded moment with two famous faces that both happen to be male conveying a perfectly synched love.

MUSIC Imagine being an artist-musician type and juggling all your favorite things just to stay afloat. Considering the Guardian’s demographic, it’s probably not too hard to imagine. This could be you. I’m not saying I feel sorry for you; it actually sounds fun if you can make it work. But at the same time, it’s got to be a constant hustle. That’s exactly how it goes for KIT, a band that — with members based out of Los Angeles and Oakland — has the California coast on lockdown.

KIT’s new album Invocation is out on Upset the Rhythm. Admittedly, sometimes I judge albums by their covers, and on this one, the colorful heap of junk, outdated toys, and discarded household items by Jessalyn Aaland could certainly read as foreshadowing to the dissonance of the sounds inside. Guitarist George Chen’s clashing and self-described “burly” sound is apparent throughout the collection, a follow-up to 2007’s Broken Voyage (also on Upset the Rhythm). In its entirety, the record clocks in at about 30 minutes.

Producer Phil Elverum, fresh from working with Mirah, gave the album a more “linear and organic” approach, according to Chen, helping them shift away from the digital tinkering and overdubs of their first effort. “I really liked how he did heavy guitar rock on [Mount Eerie’s] Black Wooden Ceiling and got it into my head that he would be an interesting choice to work with,” says Chen.

The band agreed on its new Pacific Northwest producer, known for his unorthodox recordings with Mount Eerie and the Microphones. Previously KIT had employed its drummer, Vice Cooler, as producer, while bringing in an engineer or two. This time around, the band goes analog. Bassist Steve Touchton says the album was recorded in less than one week.

Comparisons between KIT and bands such as Erase Errata and Deerhoof (who they shared a split 7-inch single with) do make sense. The chanting repetition of the word destiny on “Golden” is pretty infectious. Overall, that track stands out as a winner. “Sharks” is for extended listening and will make you stagger with its penetrating, drone-like, single-note guitar lick. The mood to hear the cacophony near the end may not always strike you, but the song conveys a sense of urgency.

“Cloud Chaser” is about creating your own sunshine on a cloudy day. I’m not joking. Kristy Gesch, KIT’s vocalist, sings about seeing someone, who I can only imagine is her boo, during a dreary day, and how when they’re happy, she’s happy. The song’s chief strength is its haiku-like simplicity — the lyric is four lines long.

At times, the album’s drenched-in-sunshine sound is juxtaposed with darker lyrical content. “Broke Heart” sounds more like the death of a loved one than the kind of heartbreak you experience from a breakup. Gesch wails about a nightmare that is both unfortunate and permanent. Perhaps this is one of the reasons Invocation finds KIT in a more reflective and inward state. I can’t confirm what exactly went down in the band’s personal lives.

I have a feeling KIT is one of those bands that sounds even better live. I don’t mean this in an insulting way and am not saying they don’t translate well to record. Given the sheer energy of its sound and knowing the types of places it plays, KIT’s all-inclusive philosophy is a stance that says nay to the ageist outlook that only 21-and-ups should enjoy this kind of music.

“It does turn out that all-ages shows by their nature are more fun than bar shows,” says Chen. “The younger kids are more amped on hearing music and not just having it as a soundtrack to drinking.”

FILM Danny Boyle is a director whose projects seem chosen largely to have nothing in common with anything he’s done before. Mid-career at 54, he’s been good at a lot of things. But what, exactly, is his ideal fit?

Falling in the “good” department are 202’s 28 Days Later, which revivified the zombie flick at the cost of subsequent overexposure, not to mention introducing that whole “fast-moving zombie” conundrum. Children’s fantasy Millions (2004) had real charm almost overwhelmed by ADD; Sunshine (2007) was sci-fi so gorgeous you could almost ignore the black hole its narrative vanished into.

Not so hot were 1997’s A Life Less Ordinary and 2000’s The Beach, the latter from a novel that “couldn’t miss.” Which proved Boyle is capable of seizing on an approach entirely wrong for his material, his confidence unflagging to the bitter end. Shallow Grave (1994) was a cunning debut that owed a lot to John Hodge’s screenplay, yet made sure you couldn’t miss the directorial panache.

Which leaves 1996’s Trainspotting, the one perfect match of gonzo content and hyperactive execution. Plus 2008’s Slumdog Millionaire, of course — a Piccadilly masala of tragedy, coarse humor, melodrama, spectacle, outrageous fortune, grotesquerie, and whipped cream. Did Boyle and company truly fuse those elements, or just smash them haphazardly together? Most people were too dazzled by exoticism to care. But will its brief vogue eventually look like one of those pop anomalies more puzzling than nostalgic?

After that large-scale, Oscar-draped triumph, 127 Hours might seem starkly minimalist — if Boyle weren’t allergic to such terms. Based on Aron Ralston’s memoir Between a Rock and a Hard Place, it’s a tale defined by tight quarters, minimal “action,” and maximum peril: man gets pinned by rock in the middle of nowhere, must somehow free himself or die.

More precisely, in 2003 experienced trekker Ralston biked and hiked into Utah’s Blue John Canyon, falling into a crevasse when a boulder gave way under his feet. He landed unharmed … save a right arm pinioned by a rock too securely wedged, solid, and heavy to budge. He’d told no one where he’d gone for the weekend; dehydration death was far more likely than being found.

For those few who haven’t heard how he escaped this predicament, suffice it to say the solution was uniquely unpleasant enough to make the national news (and launch a motivational-speaking career). Yes, it was way worse than drinking one’s own pee.

Opinions vary about the book. It’s well written, an undeniably amazing story, but some folks just don’t like him. Alternating chapters between the canyon crisis and prior “hair-raising adventures,” Ralston is the life of every party, the apple of every eye. He’s forever leaping gung-ho into avoidable near-catastrophes (risking death by bear attack, drowning, etc.), then marveling at his luck in surviving them. Stuck passing long, possibly final hours in Blue John, he briefly experiences “regrets about not focusing on the people enough” in pursuit of “the essence of experience.” Example: once he lost two good friends by recklessly getting them near-killed in an avalanche. But oh well!

This being a Danny Boyle movie, it has of course has a much cooler soundtrack than Ralston would have mixtaped (it’s a no-Phish zone), albeit one sometimes quirky to a jarring fault. While hardly a pop-culture felon à la Baz Luhrmann, Boyle still easily errs on the side of excess flash. His 127 Hours has passages where the MTV-like cinematic gymnastics performed to keep us interested in a trapped hero are just trivializing and gratuitous.

Still, subject and interpreter match up better than one might expect, mostly because there are lengthy periods when the film simply has to let James Franco command our full attention. This actor, who has reached the verge of major stardom as a chameleon rather than a personality, has no trouble making Ralston’s plight sympathetic, alarming, poignant, and funny by turns. His protagonist is good-natured, self-deprecating, not tangibly deep but incredibly resourceful. Probably just like the real-life Ralston, only a tad more appealing, less legend-in-his-own-mind — a typical movie cheat to be grateful for here.

Steve Moss: The big duck goes on and on and on

And so you will remember, from my earlier blog (STEVE MOSS: THE BIG DUCK) that I asked Steve Moss some questions in the critical District 10 race. He answered but ducked the questions, so I put forth the relevant follow up questions. No answer at all. But the blog comments provide some interesting back and forth with Moss supporters and others in the district.  (Yes, I don’t like anonymous comments and I always sign my comments as Bruce and B3.)

Moss told us in the Guardian endorsement interview that he fully supports more sunshine and accountability in non profits. So let’s take him at his word on this one and raise again the questions he has been ducking. PG&E has invested millions of dollars over the past 10 years into Moss, his non profit (and by extension his for profit firm and the Potrero View, which he now owns and uses for his personal and political agenda.)

More, Moss’s non profit collected $1,290,000 in the past three years from the California Public Utilities Commission for energy efficiency projects, according to SF Power’s annual revenues in its 2008 to 20l0 report on its website. Loretta Lynch, former president of the CPUC, explained to us that this money for energy efficiency programs are funded by ratepayers, not utilities, and that PG&E decides each year whether Moss/SF Power gets any of this money and how much. Lynch lives on Potrero Hill.

The report also disclosed that SF Power got $150,000 from the San Francisco Public Utilities Commisson in 2008 and $125,000 in 2009.) Both the CPUC and SF PUC are widely recognized PG&E- friendly bastions. Moss got hundreds of thousands more in previous years since he incorporated his non profit in 2001.  And, according to a statement in the report, Moss is still hustling money from the big polluters in District 10 (from PG&E, Mirant and its power plant and the mayor’s office et al).

This district has been brutalized for decades by PG&E, for starters with the belatedly shuttered Hunters Point power plant and with the still fuming Potrero Hill power plant, and with the concentration of gas pipelines under the district. If elected, Moss would be the first supervisor in memory who would be a direct financial captive of PG&E.

It is only fair to the residents and businesses in his district that Moss explain before election day some basic questions: how much money in total and by year has PG&E invested in him and his non profit and profit businesses? Why has he been secretive about it?
Will he keep hustling PG&E and Mirant for more money if elected? Will he cut his ties to PG&E and the non profit/profit firms and when? How can his constituents trust him considering PG&E’s investments in him?

Other critical questions concern the $250,000 or so investment that the downtown/Chamber/PG&E/real estate/landlord/BOMA gang has made in Moss and his campaign with the full expectation of getting good returns with friendly votes that would most likely be inimical to the interests of his district. Given the huge, unprecedented money gushing into his campaign from commercial landlords, developers, PG&E, and the Chamber gang, how can district residents and businesses trust him on the critical issues of public power, closing down the Potrero power plant, tenant rights, land use, Lennar and other big developments, affordable housing, and protecting the neighborhoods and small businesses?

The critical pre-election question: If Moss can’t answer these key questions fully and forthrightly, and he keeps the Big Duck going, how can he be trusted as a district supervisor?

Full disclosure: I look out from my office window at 135 Mississippi St. at the Potrero Hill power plant, pumping out poisons every minute of every day, courtesy of PG&E and Mirant, and the PUC/City Hall.

Hold onto yer Wiggs, change comin’ to Western Addy

Morgan Fitzgibbons isn’t thinking small when it comes to goals for his Western Addition sustainability group, the Wigg Party. “We want to make our community a leader in the transformation in resilience,” he tells me during our coffee date to discuss the group’s upcoming anti-boycott “carrotmob” at Matching Half Cafe (Sat/23). 

It’s no coincidence that his language sounds a little new age-y. The basis for Fitzgibbons’ vision for the Wigglers seems grounded in the PhD of Philosopy, Cosmology, and Consciousness he received at California Institute for Integral Studies. “We’re these sacred beings,” he tells me earnestly of his San Francisco community. “This is a sacred movement – I want people to look back in a hundred years and see that.”

Woo-woo? Well yeah, but hold your jaded mutterings until you hear what the guy’s done with his convictions in “cosmological evolution,” as he puts it. Fitzgibbons has assembled a core group of Western Addition residents who operate in four different arenas of turning the area around SF’s “Wiggle” (the well-trafficked bike route through the Panhandle and between the hills in Lower Haight and Duboce Triangle) into a leader in scaled-back, neighborhood-focused living.

Their areas of attack, you ask? There’s a sustainable business group, who works on incentives for local outfits that find ways of greening their ways. For example, this Saturday’s carrotmob (you can read more about the nationally recognized concept here) is a concentrated effort to storm Matching Half’s doors with business in support of their pledge to buy a bike trailer to transport farmer’s market-purchased goods, switch to organic milk, and chuck the plastic wrap for reusable food containers. 

There’s also a local food group who works with local markets to freecycle unpurchased produce at the neighborhood’s Hayes Valley Farm, a “rescaling” group focusing on ways to limit commercial consumption, and the Wiggle Transformers, who are collaborating with the SF Bike Coalition on the Wiggle portion of their Connecting the City Initiative, a comprehensive plan to improve bike passage throughout San Francisco.

Like I said, comprehensive. And most of the core group – which Fitzgibbons pegs at around 20 party members – are under 30 years old. Which is neat-o, and most likely made possible by the group’s party ethos when it comes to fighting for what they believe. I mean, I say fighting but I think I really mean loving, or something equally hippie. A bunch of them live in a place called the Sunshine Castle, for god’s sakes, where they throw “shenanigans” (according to Fitzgibbons) after-parties for their events, like the recent 10/10/10 day of action that saw the Wigglers conduct a 50-60 person bike tour of the city’s urban farms and a coordinated garden plant in collaboration with Kitchen Garden SF

In the works are plans for a Bernal Bucks-esque local currency, which the group hopes will inspire Western Addition residents to patronize more heavily the wealth of small businesses along the Divisadero Corridor and surrounding areas (holler, happy hour at Bean Bag). 

Fitzgibbons says the hyper-localism of the Wigg Party is perfectly suited for the history and relative youth of the Western Addition neighborhood.

The Wiggle itself provides a apt symbol for the group. The Wiggle Transformers’ work is making bike traffic better for everybody, but also a physical passage that Fitzgibbons hopes will say “you’re stepping into a different place now” to bikers entering the Western Addition.

“San Francisco has always been a seed of revolution,” he reflects. “Of the younger neighborhoods – the Mission and Western Addition – Western Addition is a lot less nihilistic. With University of San Francisco near the area, there’s always going to be a lot of young people living out here, and that’s who our message resonates with. It’s such a new community.”

This last comment raises a red flag in my mind. The parties, the bike tours, it all sounds grand, but given that all this is coming from a twenty-something guy with a complicated mullet and a hoody, how much does the Wigg Party truly represent the Western Addition, an area that’s been wracked by recurring waves of gentrification and is subject, like everywhere else in the city these days, to ever-increasing rent prices and displacement of long time residents? Despite the free food at Hayes Valley, are we being sustainable, or are we being hipster-sustainable? 

“To be a truly successful movement, we’ll have to organize everybody,” Fitzgibbons says, who himself has lived in the neighborhood for three years. Among those that regularly attend Wigg meetings, there is but one long-time resident, he tells me, who plays an active role advising on how to better integrate with the neighborhood’s ongoing goals and activities. Past that, “there’s tacit support among the long-term residents, and we get a lot of family participation in our Wiggle events,” Fitzgibbons tells me.

But I trust that he’s learning as he goes. After all, in explaining his philosophy on activism to me, Fitzgibbons appropriates that sustainability champion himself: Socrates. “The only thing I know is I don’t know everything,” he smiles. “We don’t have to have all the t’s crossed and i’s dotted, but we can whip up excitement and hopefully inspire people to do this in their communities. Create that showcase.” And if figuring it all out looks like a party in the streets, sayeth the Wigglers, so be it.
