Guardian Voices: My San Francisco

I’ve spent the last 12 years learning to love and sometimes hate San Francisco, and I’ve made it my home. A few months after my 31st birthday, I drove out here from the midwest to contribute to social change in a place where I could be Black, LGBT, and a community organizer – and not be forced to have my dyke identity matter quite so much. (More on that history somewhere else…) While doing grassroots community work in this city, I found love, made life-long friends, started a family and developed an incredible multi-ethnic community that has deeply enriched my life. Over the years, we’ve shared moments of tragedy and the sweetness of victory, and all of it together has defined a “San Francisco experience” quite different from what I expected. And quite different from what the tour guides sell.

Over these years, I developed an analysis of the political, economic and cultural life of this incredibly contradictory city. I’ve come to understand the structural roots of gentrification, the nature of corporate elite rule in a supposedly progressive town, and the challenges white activists face dealing with the complexities of politics in a “majority minority” city. But most of all, it’s the people in my particular San Francisco who I’ve come to love, and I’m now carrying all of their stories with me as I move in new directions. 

My San Francisco is the people rarely quoted in the local media and most often mentioned only in the context of one social problem or another. They are the mostly poor and working-class families of color I’ve been learning from all these years, people whose daily suffering goes mostly unnoticed, whose political leadership is rarely respected, and whose view of San Francisco is rarely taken into account. This is the San Francisco largely off the political and geographic map, where neither tour buses nor politicians tend to go.

My San Francisco has been in the southeast quarter, the Frisco where people work hard and do whatever is necessary to feed their families, have loud family BBQs in the park, and rock their Giants gear as much and as often as possible. The folks getting evicted, foreclosed on, and displaced by being priced out. They are Black and Latino folks who’ve joined grassroots organizations — mostly women — who make incredible daily sacrifices to change the world. They are volunteer community organizers, who might go to school or take care of other people’s children during the day, and organize for change one meeting at a time, at night. They face the threat of deportations, police harassment, and stressful low-wage work. When they join a membership-based organization, they get a community with shared values and support, but they don’t get money, status or personal power. The Frisco families I know and love don’t identify as “moderate” or “progressive,” but they know that rich people don’t have the right to rule the world, that public education and decent housing should be basic human rights, and that it makes no sense, in the middle of such deep unemployment, to raise bus fares and make it more expensive to take the bus to work. They have compassion, common-sense, critical thinking, and courage. They should be running the city.

The grassroots leaders, activists and organizers who’ve become such an intimate part of my life and whose stories now make up “my San Francisco” don’t align nicely with most dominant ideas about this place. They are not cool, cosmopolitan and carefree. But neither are they simply victims of downtown’s political power. Their leadership is the only hope for this city that I have.

It’s the young Black women with heartbreaking stories of brothers and cousins lost through gun violence, and with less public but equally horrifying private horrors of sexual violence and abuse that have traumatized them to their core.  But they are proud to be born and raised in this city and are leading community meetings, developing campaign strategies, educating their peers about Prop. 13 and their right to quality education. I have their tears, their youthful giggles, and their dreams for the future, all here in my head. 

I have the stories of undocumented Latina immigrant women, who too suffered sexual abuse when crossing the border, but now here in the US take incredible risks and do practically everything in their power to ensure their children have a better life than their own. I have the sound of their laughter together, often in Spanish —  of  these mamas, as they make plans to call 100 people for the next meeting, and the shaking in their voice when they rise to speak out in public against the racism they witness in our public schools. These women in my San Francisco have knocked on thousands of doors, talked to tens of thousands of people about the pressing issues of our times. But they are ignored on the streets of our city and in the halls of power, invisible to so many middle class, often white, professionals and activists who just don’t know, understand, or appreciate this ‘other’ San Francisco.

I love this San Francisco, and my hope is that this column can lift up these stories in coming weeks and months. San Francisco will never, ever, become the city of our dreams until the people doing the hard, often invisible work of grassroots organizing in the communities most impacted by city’s contradictions, play a more central role in defining the city’s politics. There is new leadership emerging in communities of color, and the future of San Francisco lies in their power.

Taxes and pension reform

Our friends at CalBuzz, who are almost always right, have a point when they say that the right wing is going to use the lack of comprehensive pension reform against Jerry Brown’s tax measure in the fall. That’s unless the Legislature does something productive in August, which is always a challenge.

But whenever I hear this kind of analysis, I think about some of the political campaigns I’ve seen — the tobacco tax is an excellent example — and I wonder: Will it really make a difference?

No matter what the Leg does, Joel Fox and company are going to raise a ton of money and attack the tax plan — and no matter what happens in August, they’ll use public employees, and public employee pensions, as a flash point.

Brown could propose eliminating every dollar of pension spending tomorrow — and he’d wind up in court, because a lot of this is mandated by contracts. But even if he could get away with it, the righties would still harp about pensions. Because even if we weren’t paying modest pensions today, we used to — and in these campaigns, the facts don’t matter at all. See: Prop. 29. The truth is irrelevant when this much money is involved.

I guarantee the anti-tax groups will find some overpaid public employees and a couple of folks who spiked their pensions and they’ll plaster it all over the airwaves. And the fact that Brown and the Democrats in Sacramento are working 23 hours a day to try to craft a reform plan won’t matter a bit. Even if the reform plan passes, it won’t be enough for these clowns — and if they can outspend Brown’s side by 5-1, well … start holding bake sales for your local public school.

And by the way, who’s going to put up a lot of the money for the Jerry Tax Plan? Public-sector unions.

My point is not that Brown and the Legislature should ignore pension reform (although, as Calbuzz also notes, public-employee pensions aren’t the major cause of the state’s fiscal problems). I know it’s a huge political flashpoint, and the Righties have done an exceptional job at blaming union members for just about everything wrong with the state, and most people now believe that pensions are bankrupting us all and saddling our kids (who will work nonunion jobs with no pensions) with mountains of debt.

(Wait a second. Two wars? More than a trillion dollars wasted? The repeal of the CA vehicle license fee? Prop. 13? But never mind that; the debt’s coming from pensions.)

The missed opportunity here, and the move I wish Brown had been willing to make, was to combine the two in the same package, to wit:

We’re going to ask the public employees, who have already taken tens of millions in pay cuts and furloughs and suffered huge layoffs, to suffer even more and give up part of their pension package. And we’re going to ask everyone who benefits from the Bush tax cuts and all of the corporations who benefit from loopholes in the state code to take a proportional haircut.

Proportional — that is, if a union worker who gets a (typical) $30,000 a year pension has to pay 15 percent more of his or her paycheck a year into the pension fund, then a hedge-fund manager who makes $50 million a year has to pay 15 percent more of that paycheck to help fund for education and public services.

Everyone suffers, equally. Come on, Jerry — put that on the ballot and make Joel Fox fight it.

What are “old-fashioned” SF values?

Michael Breyer, who has never held elective office in San Francisco and is running for state Assembly, is getting a fair amount of press — and although he has nowhere near the visibility of Assessor-Recorder Phil Ting, he has the support of Sen. Dianne Feinstein and may throw a boatload of money into the race. He’s already sent out one flier that features very little about him but a lot about his (more famous) family — his father, Steven Breyer, is a justice of the U.S. Supreme Court and his uncle, Charles Breyer, is a federal judge.

But here’s what intrigued me about the mail piece: It says that

“Sacramento needs a fresh perspective. It needs old-fashioned San Francisco values.”

What, exactly, are “old-fashioned San Francisco values?” One could certainly argue that the message harkens back to a day when the city was less diverse, less progressive, less open to the sometimes-radical ideas (remember this one?) that have changed the nation and the world. Of course, exploiting the workers and destroying the environment in the name of extracting riches was a famous SF value during the Gold Rush era; so was the Chinese Exclusion Act. On the other hand, resisting the Red Scare was a great traditional SF value in the 1950s, as were civil-rights sit-ins. Free love, free drugs and free lunch were vintage SF values a decade or so later. Labor struggles against capital are also a great San Francisco value.

So what, exactly, is Mr. Breyer talking about?

I called his campaign manager, Michael Terris, who wrote the piece, and asked him if Breyer was longing for a more conservative, less diverse era. “Not at all,” he said. “Old-fashioned values mean family, schools, neighborhoods, quality-of-life issues. Those are shared by the many diverse communities in the 19th District.” He added: “The West Side sees things a little differently.”

And while one of Breyer’s main issues is education, the great San Francisco value of taxing the wealthy to provide public services isn’t part of his platform. Although he does support Gov. Brown’s tax plan for November, he does not support amending Prop. 13 to shift the burden of taxation back to commercial property. He has the strong support of the Building Owners and Managers Association, which is all about keeping taxes low on huge commercial properties owned by vastly rich outfits.

So he clearly doesn’t share my old-fashioned San Francisco values. What about yours?

UPDATE: My mistake — Feinstein hasn’t endorsed Breyer. She supported him for D5 supervisor but is staying out of this race.

 

 

Low taxes are bad for business

The teachers at San Francisco’s public schools are talking about going on strike. The contracts talks with the district are at an impasse. Things look bleak.

Well, they don’t look as bleak as things in Philadelphia, but that’s not really much in the way of good news.

Part of the issue: The district wants the teachers to accept up to nine furlough days next year. Even if the governor’s tax measure passes, four furlough days are still on the schedule.

The teachers are complaining — with good reason — that the forced days off and other concessions cost them money, as much as $5,000 a year. But there’s another issue here: Furlough days are horrible for working parents — and for the businesses that employ them.

Ron Leuty has a nice column on this in the San Francisco Business Times, which doesn’t let you read all the stories unless you subscribe, but here’s the gist:

For parents, SFUSD parents who already have barely managed through four furlough days each of the past two school years, nine each year becomes intolerable. That totals up to nearly two school weeks for which we must find some sort of childcare or one-day mini-camps — and it’s cash out of our pocket. Or it means time off. For businesses, that means lost productivity, down work time and employees who are paying more for — and worrying more about — childcare.

For low-income parents who have to miss a day’s work and a day’s pay every time the kids are out of school, it’s a serious economic issue. And the local businesses, particularly small businesses which aren’t equipped to deal with excess employee absenteeism, it’s a nightmare.

Leuty doesn’t place any blame or explain how we got to this situation, so I will: Prop. 13 (and later, Prop. 218) made it really hard to raise local taxes, and a handful of Republicans are making it hard to raise state taxes, so there’s not enough money for the schools. Americans today, particularly wealthy Americans and corporations, are taxed far less than they were for most of the century, certainly the post-War era.

Local business leaders love to talk about the value of public schools. I don’t think many serious people who have looked at the finances believe that the SFUSD is fat, bloated, or wasting a lot of money; these days, even the anti-government folks have to admit it’s a pretty lean operation.

So why won’t those business folks (and, for the matter, the Business Times) start campaigning for changes in Prop. 13 to allow communities to fund the schools and avoid these debilitating furlough days? What, is this problem supposed to get fixed by magic?

 

East Bay Endorsements for the June 5 election

There aren’t a lot of contested races in the Oakland/Berkeley area. Every member of the county Board of Supervisors is running essentially unopposed. When termed-out Assemblymember Sandra Swanson decided not to challenge state Senator Loni Hancock, the East Bay left avoided a bruising primary fight. In essence, voters will be addressing a series of no-contest primaries and two statewide ballot measures. So there’s not a lot to drive the voters to the polls.

But there are two important races — a contest for Swanson’s 18th Assembly seat and a rare election for an open seat on the Alameda County bench. Our recommendations follow.

STATE SENATOR, 9TH DISTRICT

LONI HANCOCK

Always solid on the issues, Hancock has taken a lead role in fighting bogus foreclosures and takes on the often-challenging job of killing bad bills as chair of the Public Safety Committee. She’s been a strong advocate for ending the death penalty.

STATE ASSEMBLY, 15TH DISTRICT

NANCY SKINNER

Another strong progressive, she’s currently pushing to preserve affordable education in the UC system. She’s also a leader in the campaign to tax online sales.

STATE ASSEMBLY, DISTRICT 18

ABEL GUILLEN

Several strong candidates are seeking this seat, which represents one of the most progressive districts in the state. Our choice is Abel Guillen, a member of the Peralta College Board. Guillen has a strong record in the progressive community and the support of the teacher’s and nurse’s unions. He’s a strong advocate for education and speaks about aggressively seeking new revenue (including a split-role modification of Prop. 13). We were a little concerned about his reluctance to support state Sen. Mark Leno’s efforts to allow local government more authority to raise revenue (Guillen’s worried about statewide equity) but on balance, he’s the best candidate.

We were also impressed with Rob Bonta, vice-mayor of Alameda, who is strong on transit issues and understands the needs of local government. But although he told us he would support repeal of the “three-strikes” law, he’s the candidate of law-enforcement and has the support of the Peace Officers Research Association of California, the dangerous statewide cop union that tries to block nearly every piece of progressive criminal-justice reform. He told us that in the past he’s supported the death penalty because “it’s the voters’ choice.” On the relatively simple question of legalizing pot, he said he “probably” would vote for it.

Thanks to the two-two primary system, it’s likely these two will be facing off again in November. Vote for Guillen.

SUPERIOR COURT, OFFICE NUMBER 20

TARA FLANAGAN

Three East Bay lawyers are running for this rare open seat. Our choice is Flanagan, whose progressive credentials and background make her the strongest candidate.

A former prosecutor in Los Angeles who now does civil litigation and family law, Flanagan is a supporter of open courtrooms and told us she would have no objections to cameras and tape recorders. She agreed that the administrative meetings of the county judges should be open to the public. She’s served as a temporary judge, so already has courtroom experience.

The Alameda bench is still mostly a boy’s club — only 30 percent of the judges are women, and a dismal 1.4 percent come from the LGBT community. Flanagan would bring some needed diversity to the court.

COUNTY SUPERVISOR, 5TH DISTRICT

KEITH CARSON

Incumbent Keith Carson has been a stalwart in the Oakland and Berkeley progressive communities for decades. He’s running unopposed.

As usual, California is irrelevant to the presidential primaries, except as a cash machine. The Republican Party has long since chosen its nominee; the Democratic outcome was never in doubt. So the state holds a June 5 primary that, on a national level, matters to nobody.

It’s no surprise that pundits expect turnout will be abysmally low. Except in the few Congressional districts where a high-profile primary is underway, there’s almost no news media coverage of the election.

But that doesn’t mean there aren’t some important races and issues (including the future of San Francisco’s Democratic Party) — and the lower the turnout, the more likely the outcome will lean conservative. The ballot isn’t long; it only takes a few minutes to vote. Don’t stay home June 5.

Our recommendations follow.

PRESIDENT

BARACK OBAMA

Sigh. Remember the hope? Remember the joy? Remember the dancing in the streets of the Mission as a happy city realized that the era of George Bush and The Gang was over? Remember the end of the war, and health-care reform, and fair economic policies?

Yeah, we remember, too. And we remember coming back to our senses when we realized that the first people at the table for the health-policy talks were the insurance industry lobbyists. And when more and more drones killed more and more civilian in Afghanistan, and the wars didn’t end and the country got deeper and deeper into debt.

Oh, and when Obama bailed out Wall Street — and refused to spend enough money to help the rest of us. And when his U.S. attorney decided to crack down on medical marijuana.

We could go on.

There’s no question: The first term of President Barack Obama has been a deep disappointment. And while we wish that his new pledge to tax the millionaires represented a change in outlook, the reality is that it’s most likely an election-year response to the popularity of the Occupy movement.

Last fall, when a few of the most progressive Democrats began talking about the need to challenge Obama in a primary, we had the same quick emotional reaction as many San Franciscans: Time to hold the guy accountable. Some prominent left types have vowed not to give money to the Obama campaign.

But let’s get back to reality. The last time a liberal group challenged an incumbent in a Democratic presidential primary, Senator Ted Kennedy wounded President Jimmy Carter enough to ensure the election of Ronald Reagan — and the begin of the horrible decline in the economy of the United States. We’re mad at Obama, too — but we’re realists enough to know that there is a difference between moderate and terrible, and that’s the choice we’re facing today.

The Republican Party is now entirely the party of the far right, so out of touch with reality that even Reagan would be shunned as too liberal. Mitt Romney, once the relatively centrist governor of Massachusetts, has been driven by Newt Gingrich and Rick Santorum so deeply into crazyland that he’s never coming back. We appreciate Ron Paul’s attacks on military spending and the war on drugs, but he also opposes Medicare and Social Security and says that people who don’t have private health insurance should be allowed to die for lack of medical care.

No, this one’s easy. Obama has no opposition in the Democratic Primary, but for all our concerns about his policies, we have to start supporting his re-election now.

U.S. SENATE

DIANNE FEINSTEIN

The Republicans in Washington didn’t even bother to field a serious candidate against the immensely well-funded Feinstein, who is seeking a fourth term. She’s a moderate Democrat, at best, was weak-to-terrible on the war, is hawkish on Pentagon spending (particularly Star Wars and the B-1 bomber), has supported more North Coast logging, and attempts to meddle in local politics with ridiculous ideas like promoting unknown Michael Breyer for District Five supervisor. She supported the Obama health-care bill but isn’t a fan of single-payer, referring to supporters of Medicare for all as “the far left.”

But she’s strong on choice and is embarrassing the GOP with her push for reauthorization of an expanded Violence Against Women Act. She’ll win handily against two token Republicans.

U.S. CONGRESS, DISTRICT 2

NORMAN SOLOMON

The Second District is a sprawling region stretching from the Oregon border to the Golden Gate Bridge, from the coast in as far as Trinity County. It’s home to the Marin suburbs, Sonoma and Mendocino wine country, the rough and rural Del Norte and the emerald triangle. There’s little doubt that a Democrat will represent the overwhelmingly liberal area that was for almost three decades the province of Lynn Woolsey, one of the most progressive members in Congress. The top two contenders are Norman Solomon, an author, columnist and media advocate, and Jared Huffman, a moderate member of the state Assembly from Marin.

Solomon’s not just a decent candidate — he represents a new approach to politics. He’s an antiwar crusader, journalist, and outsider who has never held elective office — but knows more about the (often corrupt) workings of Washington and the policy issues facing the nation than many Beltway experts. He’s talking about taxing Wall Street to create jobs on Main Street, about downsizing the Pentagon and promoting universal health care. He’s a worthy successor to Woolsey, and he deserves the support of every independent and progressive voter in the district.

U.S. CONGRESS, DISTRICT 12

NANCY PELOSI

Nancy Pelosi long ago stopped representing San Francisco (see: same-sex marriage) and began representing the national Democratic party and her colleagues in the House. She will never live down the privatization of the Presidio or her early support for the Iraq war, but she’s become a decent ally for Obama and if the Democrats retake the House, she’ll be setting the agenda for his second term. If the GOP stays in control, this may well be her last term.

Green Party member Barry Hermanson is challenging her, and in the old system, he’d be on the November ballot as the Green candidate. With open primaries (which are a bad idea for a lot of reasons) Hermanson needs support to finish second and keep Pelosi on her toes as we head into the fall.

U.S. CONGRESS, DISTRICT 12

BARBARA LEE

This Berkeley and Oakland district is among the most left-leaning in the country, and its representative, Barbara Lee, is well suited to the job. Unlike Pelosi, Lee speaks for the voters of her district; she was the lone voice against the Middle East wars in the early days, and remains a staunch critic of these costly, bloody, open-ended foreign military entanglements. We’re happy to endorse her for another term.

U.S. CONGRESS, DISTRICT 13

JACKIE SPEIER

Speier’s more of a Peninsula moderate than a San Francisco progressive, but she’s been strong on consumer privacy and veterans issues and has taken the lead on tightening federal rules on gas pipelines after Pacific Gas and Electric Company killed eight of her constituents. She has no credible opposition.

STATE SENATE, DISTRICT 11

MARK LENO

Mark Leno started his political career as a moderate member of the Board of Supervisors from 1998 to 2002. His high-profile legislative races — against Harry Britt for the Assembly in 2002 and against Carole Migden for the Senate in 2008 — were some of the most bitterly contested in recent history. And we often disagree with his election time endorsements, which tend toward more downtown-friendly candidates.

But Leno has won us over, time and again, with his bold progressive leadership in Sacramento and with his trailblazing approach to public policy. He is an inspiring leader who has consistently made us proud during his time in the Legislature. Leno was an early leader on the same-sex marriage issue, twice getting the Legislature to legalize same-sex unions (vetoed both times by former Gov. Arnold Schwarzenegger). He has consistently supported a single-payer health care system and laid important groundwork that could eventually break the grip that insurance companies have on our health care system. And he has been a staunch defender of the medical marijuana patients and has repeatedly pushed to overturn the ban on industrial hemp production, work that could lead to an important new industry and further relaxation of this country wasteful war on drugs. We’re happy to endorse him for another term.

STATE ASSEMBLY, DISTRICT 17

TOM AMMIANO

Ammiano is a legendary San Francisco politician with solid progressive values, unmatched courage and integrity, and a history of diligently and diplomatically working through tough issues to create ground-breaking legislation. We not only offer him our most enthusiastic endorsement — we wish that we could clone him and run him for a variety of public offices. Since his early days as an ally of Harvey Milk on gay rights issues to his creation of San Francisco’s universal health care system as a supervisor to his latest efforts to defend the rights of medical marijuana users, prison inmates, and undocumented immigrants, Ammiano has been a tireless advocate for those who lack political and economic power. As chair of Assembly Public Safety Committee, Ammiano has blocked many of the most reactionary tough-on-crime measures that have pushed our prison system to the breaking point, creating a more enlightened approach to criminal justice issues. We’re happy to have Ammiano expressing San Francisco’s values in the Capitol.

STATE ASSEMBLY, DISTRICT 19

PHIL TING

Once it became abundantly clear that Assessor-Recorder Phil Ting wasn’t going to get elected mayor, he started to set his eyes on the state Assembly. It’s an unusual choice in some ways — Ting makes a nice salary in a job that he’s doing well and that’s essentially his for life. Why would he want to make half as much money up in Sacramento in a job that he’ll be forced by term limits to leave after six years?

Ting’s answer: he’s ready for something new. We fear that a vacancy in his office would allow Mayor Ed Lee to appoint someone with less interest in tax equity (prior to Ting, the city suffered mightily under a string of political appointees in the Assessor’s Office), but we’re pleased to endorse him for the District 19 slot.

Ting has gone beyond the traditional bureaucratic, make-no-waves approach of some of his predecessors. He’s aggressively sought to collect property taxes from big institutions that are trying to escape paying (the Catholic Church, for example) and has taken a lead role in fighting foreclosures. He commissioned, on his own initiative, a report showing that a large percentage of the foreclosures in San Francisco involved some degree of fraud or improper paperwork, and while the district attorney is so far sitting on his hands, other city officials are moving to address the issue.

His big issue is tax reform, and he’s been one the very few assessors in the state to talk openly about the need to replace Prop. 13 with a split-role system that prevents the owners of commercial property from paying an ever-declining share of the tax burden. He wants to change the way the Legislature interprets Prop. 13 to close some of the egregious loopholes. It’s one of the most important issues facing the state, and Ting will arrive in Sacramento already an expert.

Ting’s only (mildly) serious opponent is Michael Breyer, son of Supreme Court Justice Breyer and a newcomer to local politics. Breyer’s only visible support is from the Building Owners and Managers Association, which dislikes Ting’s position on Prop. 13. Vote for Ting.

DEMOCRATIC COUNTY CENTRAL COMMITTEE

You can say a lot of things about Aaron Peskin, the former supervisor and retiring chair of the city’s Democratic Party, but the guy was an organizer. Four years ago, he put together a slate of candidates that wrenched control of the local party from the folks who call themselves “moderates” but who, on critical economic issues, are really better defined as conservative. Since then, the County Central Committee, which sets policy for the local party, has given its powerful endorsement mostly to progressive candidates and has taken progressive stands on almost all the ballot issues.

But the conservatives are fighting back — and with Peskin not seeking another term and a strong slate put together by the mayor’s allies seeking revenge, it’s entirely possible that the left will lose the party this year.

But there’s hope — in part because, as his parting gift, Peskin helped change state law to make the committee better reflect the Democratic voting population of the city. This year, 14 candidates will be elected from the East side of town, and 10 from the West.

We’ve chosen to endorse a full slate in each Assembly district. Although there are some candidates on the slate who aren’t as reliable as we might like, 24 will be elected, and we’re picking the 24 best.

State ballot measures

PROPOSITION 28

YES

LEGISLATIVE TERM LIMITS

Let us begin with a stipulation: We have always opposed legislative term limits, at every level of government. Term limits shift power to the executive branch, and, more insidiously, the lobbyists, who know the issues and the processes better than inexperienced legislators. The current system of term limits is a joke — a member of the state Assembly can serve only six years, which is barely enough time to learn the job, much less to handle the immense complexity of the state budget. Short-termers are more likely to seek quick fixes than structural reform. It’s one reason the state Legislatures is such a mess.

Prop. 28 won’t solve the problem entirely, but it’s a reasonable step. The measure would allow a legislator to serve a total of 12 years in office — in either the Assembly, the Senate, or a combination. So an Assembly member could serve six terms, a state Senator three terms. No more serving a stint in one house and then jumping to the other, since the term limits are cumulative, which is imperfect: A lot of members of the Assembly have gone on to notable Senate careers, and that shouldn’t be cut off.

Still, 12 years in the Assembly is enough time to become a professional at the job — and that’s a good thing. We don’t seek part-time brain surgeons and inexperienced airline pilots. Running California is complicated, and there’s nothing wrong with having people around who aren’t constantly learning on the job. Besides, these legislators still have to face elections; the voters can impose their own term limits, at any time.

Most of the good-government groups are supporting Prop. 28. Vote yes.

PROPOSITION 29

YES

CIGARETTE TAX FOR CANCER RESEARCH

Seriously: Can you walk into the ballot box and oppose higher taxes on cigarettes to fund cancer research? Of course not. All of the leading medical groups, cancer-research groups, cancer-treatment groups and smoking-cessation groups in the state support Prop. 29, which was written by the American Cancer Society and the American Heart Association.

We support it, too.

Yes, it’s a regressive tax — most smokers are in the lower-income brackets. Yes, it’s going to create a huge state fund making grants for research, and it will be hard to administer without some issues. But the barrage of ads opposing this are entirely funded by tobacco companies, which are worried about losing customers, particularly kids. A buck a pack may not dissuade adults who really want to smoke, but it’s enough to price a few more teens out of the market — and that’s only good news.

Don’t believe the big-tobacco hype. Vote yes on 29.

San Francisco ballot measures

PROPOSITION A

YES

GARBAGE CONTRACT

A tough one: Recology’s monopoly control over all aspects of San Francisco’s waste disposal system should have been put out to competitive bid a long time ago. That’s the only way for the city to ensure customers are getting the best possible rates and that the company is paying a fair franchise fee to the city. But the solution before us, Proposition A, is badly flawed public policy.

The measure would amend the 1932 ordinance that gave Recology’s predecessor companies — which were bought up and consolidated into a single behemoth corporation — indefinite control over the city’s $220 million waste stream. Residential rates are set by a Rate Board controlled mostly by the mayor, commercial rates are unregulated, and the company doesn’t even have a contract with the city.

Last year, when Recology won the city’s landfill contract — which was put out to bid as the current contract with Waste Management Inc. and its Altamont landfill was expiring — Recology completed its local monopoly. At the time, Budget Analyst Harvey Rose, Sup. David Campos, and other officials and activists called for updating the ordinance and putting the various contracts out to competitive bid.

That effort was stalled and nearly scuttled, at least in part because of the teams of lobbyists Recology hired to put pressure on City Hall, leading activists Tony Kelley and retired Judge Quentin Kopp to write this measure. They deserve credit for taking on the issue when nobody else would and for forcing everyone in the city to wake up and take notice of a scandalous 70-year-old deal.

We freely admit that the measure has some significant flaws that could hurt the city’s trash collection and recycling efforts. It would split waste collection up into five contracts, an inefficient approach that could put more garbage trucks on the roads. No single company could control all five contracts. Each of those contracts would be for just five years, which makes the complicated bidding process far too frequent, costing city resources and hindering the companies’ ability to make long-term infrastructure investments.

It would require Recology to sell its transfer station, potentially moving the waste-sorting facility to Port property along the Bay. Putting the transfer station in public hands makes sense; moving it to the waterfront might not.

On the scale of corrupt monopolies, Recology isn’t Pacific Gas and Electric Co. It’s a worker-owned company and has been willing to work in partnership with the city to create one of the best recycling and waste diversion programs in the country. For better or worse, Recology controls a well-developed waste management infrastructure that this city relies on, functioning almost like a city department.

Still, it’s unacceptable to have a single outfit, however laudatory, control such a massive part of the city’s infrastructure without a competitive bid, a franchise fee, or so much as a contract. In theory, the company could simply stop collecting trash in some parts of the city, and San Francisco could do nothing about it.

As a matter of public policy, Prop. A could have been better written and certainly could, and should, have been discussed with a much-wider group, including labor. As a matter of real politics, it’s a messy proposal that at least raises the critical question: Should Recology have a no-bid, no contract monopoly? The answer to that is no.

Prop. A will almost certainly go down to defeat; Kopp and Kelly are all alone, have no real campaign or committee and just about everyone else in town opposes it. Our endorsement is a matter of principle, a signal that this longtime garbage deal has to end. If Recology will work with the city to come up with a contract and a bid process, then Prop. A will have done its job. If not, something better will be on the ballot in the future.

For now, vote yes on A.

PROPOSITION B

YES

COIT TOWER POLICY

In theory, city department heads ought to be given fair leeway to allocate resources and run their operations. In practice, San Francisco’s Department of Recreation and Parks has been on a privatization spree, looking for ways to sell or rent public open space and facilities as a way to balance an admittedly tight budget. Prop. B seeks to slow that down a bit, by establishing as city policy the premise that Coit Tower shouldn’t be used as a cash cow to host private parties.

The tower is one of the city’s most important landmarks and a link to its radical history — murals painted during the Depression, under the Works Progress Administration, depict local labor struggles. They’re in a bit of disrepair –but that hasn’t stopped Rec-Park from trying to bring in money by renting out the place for high-end events. In fact, the tower has been closed down to the public in the past year to allow wealthy patrons to host private parties. And the city has more of that in mind.

If the mayor and his department heads were acting in good faith to preserve the city’s public spaces — by raising taxes on big business and wealthy individuals to pay for the commons, instead of raising fees on the rest of us to use what our tax dollars have already paid for — this sort of ballot measure wouldn’t be necessary.

As it is, Prop. B is a policy statement, not an ordinance or Charter amendment. It’s written fairly broadly and won’t prevent the occasional private party at Coit Tower or prevent Rec-Park from managing its budget. Vote yes.

 

Occupying the Capitol

It’s an unseasonably hot day at UC Davis, and student activists are milling around a tent city, set up especially for 100 people arriving from a four-day March on Education. The school, one of the hubs of the Occupy movement, gained notoriety when public safety Officer John Pike casually pepper sprayed a line students during a sit-in back in November. Now, officers bike through the idyllic scene, smiling and chatting up occupiers.

Everyone is preparing for the next day, March 5, the statewide day to defend education that will bring thousands of students and teachers to Sacramento to demand an end to budget cuts and fee hikes at California’s schools, community colleges, and universities.

Those on the march hope to highlight the importance of this issue, marching 79 miles from the Bay Area. The first night, the march stayed in Richmond, and the next day Richmond’s Mayor Gayle McLaughlin came out to welcome them.

Students march annually on Sacramento, and say they won’t stop until education is affordable (or, as some would demand, free). A climate of worldwide protest over disparities in wealth and opportunity, including Occupy protests in the United States, helped fuel a larger than usual turnout this year.

More than 5,000 people converged in Sacramento March 5 and marched to the Capitol building, occupying the Rotunda all day. Many chanted “no cuts, no fees, education must be free.”

Community college student throughout the state are reeling from the cuts, and resulting fee hikes—course units, once free, were raised from $26 to $36 per unit last year, and will be increased another $10 this summer. These costs go towards closing the state budget deficit, and not toward a bigger course catalogue; classes continue to be slashed.

Frances Gotoh of San Bernardino Valley College is back at school after being laid off from her longtime job at Bank of America. She said she desperately needs the retraining; without it her job prospects look dim. She needs to support her family—her 20-year-old son is also a college student—but says she can’t afford the increasing fees. “Why is education being taken away?” asked Gotoh. “It belongs to the people.”

Josselyn Torres, a psychology major at Sonoma State University, felt similarly. “Every year, the fees are getting higher but the class size is getting bigger,” said Torres, who noted that many of her friends won’t be graduating with her because so many of the classes they needed were cut. “The politicians have all gone to college. If they keep cutting our education, how can we make it as far as them?”

When the march reached the Capitol, student and state government leaders spoke on the importance of education. Students demanded an end to fee hikes and budget cuts. Assembly Speaker John Perez (D-Los Angeles) and Senate President Pro Tem Darrell Steinberg (D-Sacramento) praised student activists and expounded on the necessity of accessibility to education. Almost all speakers decried the two-thirds majority needed to raise taxes, allowing just a few Republicans to block them.

Lt. Gov. Gavin Newsom also spoke, describing the need to support education in staunchly free-market terms: “You can’t have an economic development strategy without a workforce development strategy.”

Periodically, the crowd interrupted Newsom and other politicians in the midst of making promises with chants of “show us.” They also chanted this election year threat: “You’ll hear us out or we’ll vote you out!”

Around 12:30 p.m., the permitted rally ended and thousands dispersed. About 400 stayed to “Occupy the Capitol.” The group streamed into the building and into the rotunda. California Highway Patrol officers, responsible for policing the Capitol, blocked more than 150 from entering the central area. So, communicating via the Peoples Mic with several rounds of crowd repetition for every sentence spoken, the group participated in a statewide general assembly.

Some building employees showed support, but the only politician to sit down with the protesters was Newsom, who sits on the UC Board of Regents and CSU Board of Trustees. He chatted with students, some of whom requested that he ask police to stop blocking students from meeting in the same area; he didn’t do so, but was able to convince them to give protesters in the rotunda access to bathrooms.

The group managed to collectively decide on demands of the state: support the Millionaire’s Tax ballot initiative, repeal Prop. 13, cancel all student debt, fund all education through college, and democratize the Board of Regents. When building closed at 6 p.m., officers declared the assembly unlawful and arrested 70 who refused to disperse.

Meanwhile, another 400 or so attended a permitted rally on the Capitol lawn called by several Sacramento labor unions to support Occupy the Capitol.

Over the past five years, education funding in California has been cut drastically. Spending per K-12 student per year has gone down by almost $2,000 and higher education has seen program cuts and tuition hikes. Gov. Jerry Brown’s latest budget proposal includes still more cuts to California colleges and universities.

Several proposed ballot initiatives are designed to address this. An initiative sponsored by Brown would bring spending per student per year up by $1,000, stabilizing at $7,658 (it was $7,096 in 2011-12) and reversing a five-year slide. But it would still be less than 2007-08, according to a report from the California Budget Project (CBP).

That report shows K-12 education spending is the biggest piece of the state budget, although California ranks dismally low compared to other states for spending on K-12 education: 47th in the country.

The governor’s proposal would raise funds with a combination of a tax increase for those earning $250,000 and over per year and a sales tax increase. But critics say the increase in the sales tax, which is notoriously regressive, would hurt lower and middle income families.

The measure is up against other potential ballot initiatives that would raise revenue strictly from the wealthiest Californians. The so-called Millionaire’s Tax, for example, would raise funds for education by increasing taxes on those making $1 million or more per year. The Millionaire’s Tax also has the advantage of resulting in a permanent change in the law, while Brown’s measure would apply only for the next five years.

“California’s problems have also been exacerbated by tax cuts, one-time ‘solutions,’ overly optimistic assumptions, and the fact that the two-thirds vote requirement for the legislature to approve any tax measure has blocked adoption of a balanced approach towards bridging the budget gap,” according to the CBP report.

Teachers’ unions are divided over the best ballot measure. The California Teachers’ Association has endorsed Brown’s measure, emphasizing that it includes a plan to close the budget deficit.

“The governor’s initiative is the only initiative that provides additional revenues for our classrooms and closes the state budget deficit, and guarantees local communities will receive funds to pay for the realignment of local health and public safety services that the Legislature approved last year,” said Dean Vogel, CTA president, in a press release.

But the Millionaire’s Tax was sponsored by the California Federation of Teachers, and it has now been endorsed by this student general assembly. John Rizzo, president of the City College of San Francisco Board of Trustees, also endorsed the measure.

“We’ve got to tell the state of California that we cannot continue this. We cannot continue the cuts to our community colleges, to UCs, to the California State Universities,” said Rizzo, speaking at a March 1 rally in San Francisco.

According to a recent report, of five polls conducted throughout California, each initiative has majority support, but voter prefer the Millionaire’s Tax, with a recent Field Poll showing 63 percent support.

Legislators are also at work trying to increase education funding. Assembly Speaker Perez has introduced a bill that would slash tuition fees by two-thirds at CSU and UC schools for students of families making less than $150,000 per year. The bill would also allocate funding to city colleges throughout the state, for them to determine how to best use the money.

The cost of the plan, about $1 billion, would be paid by eliminating a corporate tax loophole that the Legislature approved in 2009, which would allow companies to choose the cheaper of two formulas for calculating their taxes. Critics have called the legislation bad for business, saying that removing tax incentives would hurt California companies.

“The California Middle Class Scholarship Act is very simple,” Perez told students at UC Davis when he unveiled the bill on Feb. 3. “Too many families are getting squeezed out of higher education. For students whose families make $150,000 a year or less, too much to qualify for our current financial aid system, but not enough to be able to write a check for the cost of education, without feeling that pinch, the Middle Class Scholarship Act reduces fees at the UC system and at the CSU system by two-thirds, giving tremendous assistance to those families to make college affordable again.”

Education advocates say California needs to do something to reverse the spiraling cost of higher education in California, which could do long-term damage to the state, affecting young people and businesses that need skilled workers and spiraling out from there. And these advocates say this short-sighted strategy is easily preventable if there is the political will to address it.

“There are a lot of sources of revenue that are not being taken advantage of,” Lisa Schiff, a member of Parents for Public Schools of San Francisco, told us.

Even if tuitions were lowered or—as the most ambitious of protesters demand—higher education was made free, most former students would still be saddled with massive debt. As costs have risen, debts of hundreds of thousands of dollars are commonplace. With the job market recovery slow and painful, graduates often feel helpless to pay back their debt.

Robert Meister, a professor of Political and Social Thought at UC Santa Cruz and president of the Council of UC Faculty Associations, has long argued that the state’s higher education systems ought to focus on keeping tuitions low and student debt in check (see “In the red,” 1/11/11).

Yet he told us that growing income inequality makes people even more desperate for a college education and willing to accept levels of student debt that limit their ability to become anything more than corporate cogs after graduation. “Their ability to raise tuition is a function of the growth of income inequality,” he told us.

In his speech at UC Davis, Perez cast the issue as one of a disinvestment in the state’s future: “California’s public colleges and universities has been one of our most prestigious institutions, and, unfortunately, because of the collapse of the economy, we’ve moved away from fully investing in those universities and colleges.”

A month later, the school again served as a backdrop for illustrating the problem and calling for reform. Dani Galietti, a MFA student at UC Davis who was setting up a performance art piece when I arrived, greets everyone cheerfully and is thrilled about the Occupy movement.

“I wanted to share myself and my work with the movement,” Galietti tells me while taping a “paper trail” to the sidewalk; she plans to walk on it with home-made stamps attached to the bottoms of her shoes.

But her mood darkens when I ask about her student debt. “I came out of five years of education $100,000 in debt,” says Galietti, “and I’m not the only one.”

She is a first generation college student, she explains, who helped pay for school with McNair scholarships.

“I grew up one of five, with a single mother,” Galietti explains. “We struggled my whole life, as a lot of people have, financially.”

“So many people are graduating with so much debt. There’s this looming fear, fear and hopelessness. The economy’s bad, the job market sucks. I’m so thankful that they’re out here. People are active, they’re making a difference.”

“We need education,” Galietti says. “I mean, knowledge is power.”

 

The 8 Washington disaster goes to Planning

The urban planning disaster that is 8 Washington goes before the San Francisco City Planning Commission March 8 amid a long list of questions — including Mayor Lee’s position on the project and how it could screw up the America’s Cup.

Developer Simon Snellgrove wants to build the most expensive condos in San Francisco history on the waterfront, 145 units that will be far out of reach to anyone who makes less than half a million dollars a year. And many of the units will require income far higher than that. It’s not just housing for the 1 percent; it’s housing for the top half of the 1 percent.

There’s no need for this kind of housing in SF; the very rich have no problem finding places to live. And the spot zoning violates every standard of good waterfront planning practice.

The project will benefit the Port of San Francisco, which stands to take a cut of the money since some of the project is on Port land. But more than half of the land is owned by Golden Gateway and is a former redevelopment area, so the supervisors and the Port are going to have to fight over who gets the property tax increments and how that’s all financed.

More interesting, 8 Washington will be a boon to Golden Gateway, which as the landowner is a partner in the deal. And Golden Gateway is one of those big properties that are paying far too little in city taxes. When the complex changed hands several years ago, the owners used a stock-swap deal to transfer it, avoiding the Prop. 13 reassessment that could have substantially raised its taxes. So the city’s losing millions of dollars — and now Timothy Foo, who is the principal owner of Golden Gateway, will be getting a nice favor from the city he’s been screwing.

Oh, and by the way — a lot of Golden Gateway units are being advertised as short-term (that is, hotel) rentals — something that violates at least the spirit of city law. This is an outfit that deserves special zoning treatement from San Francisco?

Then there’s the fact that this could be a serious problem for the big America’s Cup party. Project critic Brad Paul has been analyzing the impacts of the development, and noticed some new language in the comments and responses to the Environmental Impact Report suggesting that excavation could lead to something like 200 dump-truck trips a day along the Embarcadero — roughly one trip every two minutes. In an email to Paul, Paul Matltzer in the Planning Department confirmed that the likely construction process could, indeed, involve that many dump trucks, rumbling along the Embarcadero during the peak construction period, which will also be the peak period for America’s Cup tourism.

Dump trucks, Paul (who used to drive one) notes, start slowly and brake slowly. The Embarcadero is already crowded — and will be far more crowded during the Cup races, so much so that city officials are thinking of closing traffic lanes to all but bicyles and transit. How, exactly, will that work out with 200 trucks a day fighting for room?

I’ve called and emailed the America’s Cup people, but they haven’t gotten back to me. I’ll keep you posted.

Lee’s office hasn’t gotten back to me, either, but I’m hearing that the mayor is telling people he hasn’t made up his mind — on a project that’s a week away from the Planning Commission and that one of his close allies, Rose Pak, is strongly promoting.

 

Firing bad teachers

Diane Ravich, who used to be on the wrong side of school reform but has pretty much come around, was on Forum Jan. 18 talking about education policy. For the most part, she was right on target, explaining that too much of a focus on testing (as a measure of school and teacher accomplishment, not as a diagnostic tool) and too narrow an emphasis on math and reading has damaged public schools.


Neither she nor host Michael Krasny spent much time talking about the bigger problem — money — or the fact that other nations that are eclipsing the United State in education actually tax people and spend that money on schools. California has already cut the number of classroom days, and may cut as much as a week out of the school year. That’s a huge deal, one that’s directly related to the intransigence of a few state legislators who can hold the entire budget hostage — and to the unwillingness of California residents to amend Prop. 13 and allow reasonable property taxes.


But one of the things that struck me was a caller who complained that tenure was making it impossible to fire bad teachers.


Tenure, Ravich noted, is badly misunderstood. At the college level, it’s essentially a lifetime commitment; a college professor gets tenure and he or she understands that, for the most part, it means a career at an institution — with minimal job requirements. Tenured professors teach a few classes, but are free to spend a lot of time on academic research (without any set requirement for success or publication.)


For K-12 teachers, tenure is just a word meaning that they get due process in employment. It’s basically the same as the civil-service rules that San Francisco city employees have — the right to a hearing on discipline and freedom for arbitrary actions on the part of management.


You think it’s hard to fire a teacher? Try firing a cop. The police, who have nothing called “tenure,” have more and broader rights than any other public-sector employees, including the right to have all disciplinary matters kept completely secret. And police officers are armed and given the ability to arrest and even shoot people.


So yeah, let’s blame the inability to fire teachers. That’ll fix the problems. 

Editorial: Mayor Lee, support Prop. 13 reform

EDITORIAL You want a quick way to cut a huge chunk out of the city’s budget deficit? A way to save essential services without having to put a tax increase before the voters?

Just force the owners of large commercial properties to pay their property taxes.

It’s an open secret in California that the biggest properties are bought and sold under a loophole in the Proposition 13 that prevents city’s from reassessing them. It’s a fairly easy scam, one that almost never happens with lower-priced residential property: Instead of selling, say, a large commercial office building, the owners simply incorporate the building as a limited liability corporation and then sell shares in the LLC. That doesn’t count as a property transfer under Proposition 13, so the building is never reassessed.

That means a building that may have sold for $500 million still pays taxes on an earlier assessment, which is often far, far lower. That loophole alone is costing San Francisco millions of dollars a year, according to Assessor Phil Ting.

The California Tax Reform Association, in a May, 2010 report, notes that many of the biggest mergers, acquisitions, and property sales in the state over the past 30 years have taken place with legal tricks that keep property taxes artificially low.

Assembly Member Tom Ammiano has introduced a bill, AB 448, that would classify any substantive transfer of property, even if it’s done through subsidiaries and corporate shells, as a sale and allow counties to reassess the property. It’s a fairly mild step, far short of a split-roll measure that would treat commercial and residential property differently. In fact, Ting told us, 99 percent of all commercial sales (mostly smaller properties) don’t use the loophole. It’s just (once again) the 1 percent taking advantage of everyone else.

Los Angeles Mayor Antonio Villaraigosa has contacted Ammiano and asked to testify and help pass the bill. But at press time, Ammiano had heard nothing from San Francisco Mayor Ed Lee. (Lee’s spokesperson, Christine Falvey, told us she didn’t think the bill was still alive. It is.)

Lee needs to take a high-profile position in support of this bill — and he needs to encourage every other mayor in the state to do the same. The Board of Supervisors ought to pass a resolution of support — and push the County Supervisors Association of California to make this bill a top priority.

Making even a minor, eminently reasonable change in Prop. 13 is tough, and Ammiano’s best chance is if local elected officials really push for this. It’s crazy that Mayor Lee isn’t leading the way.

 

Who will push progressive taxes in 2012?

Mayor Ed Lee talked to the Examiner about his plans for the next year, and it’s a lot of the usual political crap: I’m going to create jobs, I’m going to bring people together and promote civility, ho hum. But he did mention, briefly, the need to change the city’s business tax, and here’s how he put it:

We have given ourselves four months to reach out to all the business groups. There will be different views and opinions. You can have a hybrid [between a payroll and gross receipts tax], and you can also have a phase-in period of time. We want to have a good conversation with everybody and get their best ideas, and then use those ideas to craft what we think could be on the ballot. We’re not saying it has to be on the November ballot, but it could be. We want to have something that is not job punishing, but also something that does not decrease our revenue.

First: He’s going to reach out to all the business groups — but what about everyone else in the city? The level of business taxes has a direct impact on city services; is that not part of the equation? Clearly, he’s talking about something that’s at best revenue-neutral, something that “does not decrease our revenue.”

And please, don’t tell me about “job punishing” — it makes me even crazier than I already am. Look: There has to be a business tax in San Francisco. And any time you tax businesses, you take money for the city that could be used for other things. In some cases — not that many — the extra money might be used to hire a few people. In reality, for most businesses, the payroll tax is absolutely NOT a factor in job creation. It sounds bad — Gasp! a tax on jobs! — but the truth is that payroll is a rough approximation for the size of a company, and that’s what the city uses as a tax base.

Of course, we could change that to a gross receipts tax — another rough approximation for the size of a company. It’s also imperfect — some companies have a lot of money (VC funding, for example) and a lot of employees, but at this point not much in the way of sales. Some companies (supermarkets, for example) have high gross receipts but relatively low profit margins. And, of course, if you do a gross receipts tax the same people who complain about the payroll tax will have a new line: The GR tax penalizes growth! It penalizes success! The more money you make the more you pay! Unfair! Un-American! Job killer!

Because some people in this town (mostly big business types) just want lower taxes, period — not different taxes, lower taxes

So let’s get rid of the “job killer” rhetoric and start talking about what the city’s tax policy should be. And it should go like this: The individuals and businesses with the most money should pay the highest tax rates. The rich don’t pay their fare share anywhere in the U.S., and while the mayor and the supervisors can’t change federal policy, they can do their part on a modest level at home.

This a great year for tax reform in San Francisco. The spirit of Occupy is very much alive. There is, for the first time in decades, a national discussion about income and wealth inequality. There’s strong evidence that the middle class is vanishing in San Francisco. And, thanks to the wierdness of state law, in 2012, when there’s an election for the Board of Supervisors, a tax measure can pass with a simple majority vote In many ways, this is the single most important policy issue in the city, the one that defines who pays for what and who gets what and whether (public sector) jobs are created or destroyed and what kind of a city we want to be.

So let’s take it seriously. Instead of allowing Mayor Lee and the (big) business folks set the agenda, the progressives really need to move forward on a tax-reform plan that looks at making big business pay more and small business pay less — and that brings in another $250 million a year for the local coffers If gross receipts is the flavor of the day, I’m good with that — but not a flat tax. Exempt, say, the first $250,000 (or the first $500,000, whatever, run the numbers and see what we can afford). Put a 1 percent tax on the next million, a 1.5 percent tax on all receipts between $1.5 million and $5 million, a 2 percent tax on $5 million to $10 million and 3 percent on everything higher. Adjust the numbers either way, but that’s the general idea. Then add in a tax on commercial rents (again, exempt the first $500,000 or whatever) to make sure the the big landlords (who get away with murder under Prop. 13) are paying, too. And yes, based on market supply and demand, some will try to pass that on to their tenants, but companies (including a lot of law firms) that rent enough space to be paying millions of dollars a year in rent can afford to modest tax hike.

It will take the city controller or the city’s economist to do the math and see what the options are and how you get to $250 million net new revenue, so my proposal is just a start. But somebody needs to take this on, some member of the Board of Supervisors — or else we’ll just be responding to what the Chamber of Commerce wants. Who wants to be the champion of Tax Reform for the 99 Percent? Time is getting short.

The Phil Ting for Assembly campaign is under way

Just a few days after the race for mayor of San Francisco ended, Assessor-Recorder (and mayoral candidate) Phil Ting began his next campaign — for state Assembly.

The Westside district now represented by Fiona Ma opens up in 2012, when Ma will be termed out. And Ting was moving to set himself up as the frontrunner almost as soon as the ink had dried on on the final results from the mayoral election (where he finished a disappointing 11th, behind even Green Party candidate Terry Baum). Philting.com, which had been the official website for Phil Ting for Mayor, has been switched over to Phil Ting for state Assembly. I got an email Dec. 7 inviting me to a reception for his Assembly campaign; several prominent local politicians told me Ting had called even earlier than that to ask for support.

And he’s getting it — both state Sen. Mark Leno and Assemblymember Tom Ammiano are on his already-impressive list of endorsments.

Which is no surprise: The 12th District (which will become the 19th under the new redistricting) is the more conservative side of San Francisco, and by the standards of the state Assembly, Ting would be a pretty solid progressive. He actually understands tax policy, and he’s made a huge issue of removing the commercial property loophole from Prop. 13.

So now comes the interesting part: Who’s going to run against him?

Ting has a relatively cordial relationship with Mayor Ed Lee, and didn’t spend much time in the campaign attacking the appointed incumbent. He’s a former executive director of the Asian Law Caucus, where Lee worked in his early days as a tenant and civil-rights lawyer. There shouldn’t be any reason for the mayor or his pals to try to drum up a candidate to take on Ting … or should there?

Ting is not an enemy of the Willie Brown-Rose Pak folks. But he’s not a loyal ally, either. The most obvious conservative/pro-downtown candidate, one the mayor and his big-business pals could count on, would be Sup. Carmen Chu. I couldn’t get her on the phone, but in the past she’s been only lukewarm about running. The other strong potential candidate would be Sup Sean Elsbernd, but he told me he’s absolutely not running. “I was very interested during my first few years on the Board, but since my son was born, there’s no way I would consider it,” he said. “I am not a candidate and shouldn’t be talked about as a candidate.”

So will we see a “Run, Carmen, Run” campaign? Or will Brown and Pak think about it and realize that giving the mayor an appointment to Ting’s office might be a real advantage? Would they rather control a state Assemblymember — of the county assessor?

Protesters target UC to demand openness, accountability, and the restoration of cuts

UPDATED BELOW — Protesters with ReFund California and other groups are gathering today (Mon/28) at UCSF-Mission Bay and three other UC campuses to protest a teleconference of the UC Board of Regents, which will discuss state funding levels and tuition increases, as well as recent incidents of police violence against nonviolent student protesters.

ReFund California, a coalition of student and labor groups, is angry with the UC’s decision to abruptly cancel the Nov. 16-17 Regents meeting at UCSF, citing public safety concerns surrounding a meeting that the group had been planning a convergence on for months – as well as a hastily called meeting on the day after Thanksgiving.

The group has created a pledge that it wants the Regents to agree to, which includes calling for higher taxes on the rich, a restoration of cuts to the public university systems, removal of commercial land from Prop. 13 property tax caps, and a fee on Wall Street financial transactions.

ReFund California is also dismissive of independent investigations the UC has initiated to look at aggressive police repression of students protests, including police at UC Berkeley using batons and mass arrests to dismantle an OccupyCal tent city and police at UC Davis dousing passive protesters with pepper spray. Video of both incidents went viral and have helped galvanize the overlapping Occupy and student movements.

“No amount of new ‘police protocols’ will prevent violence against students and workers, as long California’s corporate and financial elite along with their representatives among the Regents and administrators of the UC rely on police to address the concerns of students and workers,” the ReFund California Coalition wrote in the letter to the UC.

Today’s action at UCSF – centered around the meeting site at 1675 Owens Street, where a Guardian reporter is on the scene and will offer her report later today – joins similar protests at UC Davis, UCLA, and UC Merced, the four sites where the Regents will gather.

Meanwhile, ReFund and other groups are also angry that the CSU Board of Trustees went ahead with its Nov. 16 meeting behind closed doors, clearing out student protesters and the public before they approved a 9 percent tuition hike, an action that Lt. Gov. Gavin Newsom (a member of that body) denounced.

“While I understand the CSU leadership’s concerns regarding public safety, the spirit of open deliberations has been marred,” Newsom wrote in a Nov. 18 letter to Chancellor Charles Reed, calling for the matter to be re-voted at the Dec. 5 meeting to “allow the full board to hold an open debate, with full public comment and members of the media present.”

In related news, many students and faculty at UC Davis are on strike today to protest the pepper-spraying incident. And tomorrow (Tues/29) at noon, members of OccupyOakland say they plan to retake Frank Ogawa Plaza (which they renamed Oscar Grant Plaza) and set up another 24/7 encampment.

UPDATE NOON: Guardian reporter Christine Deakers says there is a heavy police presence at the UCSF meeting, where only 50 members of the public are allowed inside and most of those seats have been claimed by ReFund California members. When the Regents decided to limit the time for public testimony, the group held a General Assembly in the meeting, drowning out the Regents and causing the meeting to adjourn until 1:30 pm. UPDATE 1:50 PM: The UC Board of Regents did not reconvene, instead cancelling the rest of the meeting without taking action. The San Francisco Chronicle quotes Newsom as saying he supports the demands of ReFund but that he’s not willing to sign its pledge.

The growing 99 percent

In recent weeks, the Bay Area has been roiled by anger and frustration with how the rich have grown richer while the rest of us endure underemployment, foreclosures, and deep cuts to public education and services, peaking with the Nov. 2 Oakland General Strike that drew more than 10,000 people into the streets to demand economic justice.

The Occupy Wall Street movement — and its many local manifestations, including OccupySF and Occupy Oakland — has been the main vehicle for those populist passions for the last two months, with the support of the labor movement. But now, student and faculty groups from California’s three public university systems are about to get involved in the fight in a big way.

Student and labor groups allied with the ReFund California coalition are planning a week of action for Nov. 9-16, culminating that final day in demonstrations outside the California State University Board of Trustees meeting in Fullerton and University of California Board of Trustees meeting at the UCSF campus in San Francisco’s Mission Bay.

Those protests aim to connect the problem of deep cuts and tuition hikes in the public university systems with the larger issue of wealthy individuals and corporations that haven’t been paying their fair share. The coalition wants the boards to pledge support for a five-point action plan that includes taxes on the wealthy, removing commercial property from Prop. 13 caps on property taxes, restoration of cuts to higher education, a sales tax on Wall Street financial transactions, and pressuring banks to reduce mortgage debt on underwater homes.

Charlie Eaton, a ReFund California organizer from United Auto Workers Local 2865, which represents teaching assistants at UC, notes that many UC and CSU board members also sit on the boards of major banks and corporations that have contributed to the current financial crisis and which have been in the crosshairs of the Occupy Wall Street movement.

“It’s really a club of California’s corporate elites,” Eaton said. “It’s about saying to these folks: if you aren’t willing to actively support paying your fair share, or at least get out of the way, we can’t let it be business as usual at the Wall Street institutions that you help run.”

 

NO BUSINESS AS USUAL

He said there’s a direct connection between the actions of these corporate boards and lack of resources in California for public education and services, so it’s only right that these powerful board members — from Regent Richard Blum, the investment banker husband of Sen. Dianne Feinstein, to Trustee Bill Hauck, former head of the California Business Roundtable — support the needs of the 99 percent.

“We’ll be there to call on them to sign the pledge,” Eaton said of the Nov. 16 meetings. “And if they aren’t prepared to make that pledge, we’re headed to the Financial District to make sure there is no business as usual for these corporations.”

That day of action will echo the last ReFund California protest in San Francisco, the Sept. 29 “Make Banks Pay” march through the Financial District that was one of the first high-profile demonstrations involving OccupySF. The march was several hundred strong, targeting major financial institutions including a Chase Bank branch on Market Street that was occupied by protesters, resulting in six arrests.

When we asked Eaton whether the Occupy movement would lend its energy and numbers to these ReFund California protests, he said, “We’re embedded in the Occupy movement, so it’s not quite right to say it’s something the Occupy movement might help with…I think the Occupy Wall Street movement shows we can make them pay.”

Meanwhile, the next day (Nov. 17), Occupy Wall Street plans to march the 11-mile length of Manhattan in a day of action that will be supported by solidarity marches by Occupy encampments across the country. That is also the day that a two-campus strike is being threatened by the California Faculty Association.

“I think that day is going to be a busy day all around the nation,” Kim Geron, a political science professor at CSU East Bay and vice president of the CFA, told us.

On Nov. 7, the CFA Board of Directors authorized one-day strikes for Nov. 17 at the CSU East Bay and CSU Dominguez Hills campuses to protest CSU Chancellor Charles B. Reed’s decision to withhold negotiated faculty pay raises. It would be the first faculty strike in the system since 1983, although a strike was authorized in 2007 but called off after a negotiated settlement.

After the vote, according to a statement put out to members, CFA President Lillian Taiz told her board, “We hope this carefully targeted strike, which symbolizes both our anger and our commitment to fairness, will lead to changes in his priorities and his positions. If it does not, the CFA leadership—and the CSU faculty we represent—are prepared to escalate the fight.”

 

DUCKING THE TAX ISSUE

CSU spokesperson Mike Uhlenkamp said the campuses will remain open despite the strikes. “We expect it to be business as usual,” he said. As for the pledge that ReFund California is seeking, “We don’t get into advocating between taxing and not taxing,” he said, saying that’s a state decision and “we’re not going to push them to make that determination.”

Guardian calls to the UC President’s Office were not returned by press time. A spokesperson for Gov. Jerry Brown, who is the subject of a student letter-writing campaign urging him to tax the rich and stop cutting public services, continued to blame Republicans.

“We too are deeply concerned about cuts to the state’s universities and colleges, which is why the Governor pushed for a solution to our budget deficit that included extending revenues. Unfortunately, Republicans in the Legislature refused to even allow the people of California to vote on the measure, which could have helped prevent future cuts,” Brown spokesperson Evan Westrup responded via email.

When we asked whether Brown was simply giving up, how he planned to deal with the problem, and why Brown has not followed up his campaign pledge to tax the rich with any proposals to do so, he wrote simply, “There are a number of ways to pursue additional revenue moving forward and these options are being considered.”

Geron said there is a clear connection between problems in the CSU system and the hoarding of resources by the richest one percent of Americans, the main critique of Occupy Wall Street, a movement driven largely by current and recent college students.

“We are part of it. One of our slogans is we are the 99 percent and we teach the 99 percent,” Geron told us.

While the CFU is focused on decisions by the Chancellor’s Office — indeed, the strike is legally allowed only because the chancellor broke the contract by withholding negotiated pay increases — Geron said those decisions were made in a climate of deep funding cuts prompted by the state budget crisis.

“Obviously, the economic crisis is a lot of the reason why all this happened. It’s part of a larger crisis that is going on about how to fund the public good, including higher education,” Geron said. “Students are paying a lot more and getting a lot less. That’s the heart of what’s going on.”

The UC Student Association is taking part in the ReFund California week of action, but has not yet voted to participate in direct action against corporations on Nov. 16, Executive Director Matt Haney told us. But he said that many UC students will still take part in that action, just as they’ve been taking part in the Occupy movement.

“It’s the same frustrations. We have to get out there and start pushing this ourselves,” he told us. “We need to show the state that things can’t just keep moving along as they have. We have to put a stop to business as usual. The economic collapse is what destroyed the UC system.”

Haney sees the student, labor, and Occupy movements starting to come together in a very natural way. “It has really put the wind in the sails of student activists to see the energy of the Occupy movement,” Haney said. “There is a coming together of students and labor, and it’s overlapping with the Occupy movement in a powerful way.” *

Alioto-Pier plays the school card

Former Supervisor Michela Alioto-Pier is barely registering in the mayoral polls and at this point has about zero chance of getting elected. So she’s thrown out a desperation pitch, trying to get votes from people who think kids should all go to neighborhood schools.

A mailer that I got yesterday shows two sad looking children in front of a Muni bus with the line: “Our ride to school is longer than our parents’ ride to work. Who will stand up and fight for us?”

There are shades of the old (sometimes racist) anti-busing stuff here — why should kids have to ride buses – buses — to go to a school that isn’t right in the neighborhood? There’s also very much a class issue — the public schools in rich neighborhoods have resources (that is, rich parents) that schools in poor neighborhoods don’t. So kids who grow up in (still segregated) poor neighborhoods won’t get a chance to have the same quality education as kids who had the skill and drive that it took to be born to wealthy parents.

Sure, we could “make every school a great school,” as the neighborhood schools crew likes to say — but that would take money. Tax money. Lots more tax money.  And I don’t hear Alioto-Pier talking about repealing Prop. 13.

Here’s the reality: In most public schools, parents have to raise money to supplement what the district can offer. You want smaller classes, or language options? Fine — come up with $50,000. Hold fundraisers, write grants, beg and plead — and some school communities are very good at it. Clarendon routinely raises $200,000 or more a year. My daughter’s school, McKinley, holds a car was and Dog Fest, and we got a corporate grant to rebuild the playground. Those things take (a) parents who have time and (b) parents with the skills to write grants and (c) parents who have money to contribute on their own.

You segregate school attendance by neighborhood and you’ll get some schools that have a lot of a, b, and c — and some that have almost none. Now, you could “tax” the good fundraisers — force, say, the Clarendon and McKinley parents to give 25 percent of everything they raise to other schools that don’t have the same parent resources. I’m not actually against that. But it’s almost impossible to administer and unlikely to happen.

Or you could say that parents all over town have the right to choose a school anywhere, including one of the ones in the wealthier parts of town. Then the parents who have resources wind up helping out kids who come from poorer families, because the schools are more socio-economically diverse.

There’s also the fact that San Francisco is a pretty small city; taking a bus from my neighborhood, Bernal Heights, to my son’s middle school, Aptos — in a different neighborhood in another part of town — isn’t that big a deal.

And there’s the indisputable fact that most parents don’t want to be limited to their neighborhood schools. They want choice. There are different types of programs for different kids — and you can’t have Mandarin, Spanish and Japanese immersion all offered at every single elementary school. 

And by the way: Most parents who want to send their kids to the nearby schools get their way already. The new assignment policy gives priorioty to neighborhood residents. And 80 percent of the parents who enter the lottery get one of their seven choices. (Enter the lottery and chose your neighborhood school and the odds are pretty good that you’ll get it. But a lot of people don’t do that — they want a different program or opportunity somewhere else. San Francisco very rarely forces kids to take long bus rides; those kids mostly go to schools that their parents chose for them.) It’s not a perfect system, but as a parent who’s been through it (twice), I can tell you it’s really not that bad.

Then there’s the fact that the mayor doesn’t actually get to decide any of this. The school assigment policy is set by the School Board. So even if Alioto-Pier got elected, there’s no way she could implement the “neighborhood school plan” that she’s talking about.

This is just outright pandering to a West Side crowd. And it’s probably a waste of paper and ink — Alioto-Pier’s not going back to City Hall.

Where’s the “tax the rich” move in SF?

Warren Buffett may have actually set off a movement with his NY Times oped calling for higher taxes on the rich. That’s what Carla Marinucci, who is not known as a socialist radical, reports today in the Chronicle. 


Billionaire Warren Buffett may not seem to have much in common with angry laborers at town hall meetings or armies of California nurses protesting in the streets.


But these days, the executive celebrity in his boardroom and working folks on the front lines have found a common mantra as the economy continues to sputter and the 2012 election approaches: “Tax the rich.”


It’s a great time to be talking about this — The Institute for Policy Studies just released a report showing that a lot of major corporations paid their CEOs more money last year than they paid in federal taxes. And as the economy continues to sputter, voters are going to keep asking why the rich are doing so well and the rest of us are doing worse and worse.


So let’s make this the center of the mayor’s race in San Francisco.


The nurse’s union is taking on the tax issue directly. The nurses’ candidate for mayor of San Francisco, Leland Yee, doesn’t even mention “taxes” on his list of issues in the race.


Progressive leader John Avalos talks about bringing in $40 million in new revenue, and he has told me many times that he supports taxing the rich. But those words aren’t on his issues page, either. Phil Ting supports repealing part of Prop. 13, but his website talks only of bringing in new revenue without raising taxes. David Chiu wants to reform the business tax, which is a good idea — but again, the word “tax” isn’t on his issue list, and there’s nothing about the rich at all. Bevan Dufty? Nothing about taxes at all. Ed Lee? Zero.


The only leading candidate whose website actually mentions tax reform as a leading issue is Dennis Herrera, who mentions repealing the payroll tax and holding a “tax summit.” His analysis of the payroll tax is dubious, but at least he uses the word “fair.” He doesn’t, however, use the word “rich.”


So here was have the mainstream of the Democratic Party and even ol’ Nancy Pelosi talking about making the wealthy pay their fair share, and in San Francisco, which is supposed to be the most liberal big city in America, it’s not even on the agenda.


Am I the only one who thinks this is a problem?

The real Leland Yee

It’s early January 2011, and the Four Seas restaurant at Grant and Clay is packed. Everyone who is anyone in Chinatown is there — and for good reason. In a few days, the Board of Supervisors is expected to appoint the city’s first Asian mayor.

The rally is billed as a statement of support for Ed Lee, the mild-mannered bureaucrat and reluctant mayoral hopeful. But that’s not the entire — or even, perhaps, the central — agenda.

Rose Pak, who describes herself as a consultant to the Chinese Chamber of Commerce but who is more widely known as a Chinatown powerbroker, is the host of the event. She stands in front of the room, takes the microphone, and, in Cantonese, delivers a remarkable political speech.

According to people in the audience, she says, in essence, that the community has come out to celebrate and support Ed Lee — but that’s just the start. She also urges them not just to promote their candidate — but to do everything possible to prevent Leland Yee from becoming mayor.

She continues on for several minutes, lambasting Yee, the state Senator who lived in Chinatown as a child, accusing him of about every possible political sin — and turning the Lee rally into an anti-Yee crusade. And nobody in the crowd seems terribly surprised.

Across Chinatown, from the liberal nonprofits to the conservative Chamber of Commerce, there’s a palpable fear and distrust of the man who for years has been among San Francisco’s most prominent Asian politicians — and who, had Lee not changed his mind and decided to run for a full term this fall, was the odds-on favorite to become the city’s first elected Chinese mayor.

The reasons for that fear are complex and say a lot about the changing politics of Asian San Francisco, the power structure of a city where an old political machine is making a bold bid to recover its lucrative clout — and about the career of Yee himself.

Senator Leland Yee is a political puzzle. He’s a Chinese immigrant who has built a political base almost entirely outside of the traditional Chinatown community. He’s a politician who once represented a deeply conservative district, opposed tenant protections, voted against transgender health benefits and sided with Pacific Gas and Electric Co. on key environmental issues — and now has the support of some of the most progressive organizations in the city. He’s taken large sums of campaign money from some of the worst polluters in California, but gets high marks from the Sierra Club.

His roots are as a fiscal conservative — yet he’s been the only Democrat in Sacramento to reject budget compromises on the grounds that they required too many spending cuts.

He’s grown, changed, and developed his positions over time. Or he’s become an expert at political pandering, telling every group exactly what it wants to hear. He’s the best chance progressives have of keeping the corrupt old political machine out of City Hall — or he’s a chameleon who will be a nightmare for progressive San Francisco.

Or maybe he’s a little bit of all of that.

 

Leland Yin Yee was born in Taishan, a city in China’s Guangdong province on the South China Sea. The year was 1948; Mao Zedong’s Communist Party of China had taken control of much of the countryside and was moving rapidly to take the major cities. The nationalist army of General Chiang Kai-Shek was falling apart, and Yee’s father, who owned a store, decided it was time for the family to leave.

The Yees made it to Hong Kong, and since Mee G. Yee had previously lived in the United States and served in the U.S. Army during World War II, he was ultimately able to move the family to San Francisco. In 1951, the three-year-old Leland Yee arrived in Chinatown.

For four years, Yee lived with his sister and mother in a one-room apartment with a shared bathroom while his father worked as a sailor in the merchant marine. It was, Yee recalled in a recent interview, a tight, closed, and largely self-sufficient community.

“The movie theater, the shoe store, the barber shop, food — everything you needed you could get in Chinatown,” Yee said. “You never had to leave.”

Of course, after a while, Yee and his mom started to venture out, down Stockton Street to Market, where they’d shop at the Emporium, the venerable department store. “It was like walking into a different country,” he said. “If you didn’t know English, they didn’t have time for you.”

Yee, like a lot of young Chinese immigrants of his era, put much of his time into his studies — in the San Francisco public schools and in a local Chinese school. “My mom spoke a village dialect, and we had to learn Cantonese,” he said. “Every little kid had to go to Chinese school. We hated it.”

When Yee was eight, his parents managed to buy a four-unit building on Dolores Street, and the family moved to the Mission, where he would spend not only the rest of his childhood but much of his early adult life. He graduated from Mission High School, enrolled in City College, studied psychology and after two years won admission to UC Berkeley.

Berkeley in 1968 was a very different world from Chinatown and even the relatively controlled environment he’d experienced at home in the Mission. “You didn’t protest in school. You’d have been sent home, and your mother would kill you,” he said.

At Berekely, all hell was breaking loose, with the antiwar protests, the People’s Park demonstrations, the campaign to create a Third World College (which led to the first Ethnic Studies Department), and a general attitude of mistrust for authority. “I developed a sense of activism,” Yee said. “I realized I could speak out.”

That spirit quickly vanished when Yee lost faith in some of his fellow activists. “People would work with us, then get into positions of power and use that against you,” he recalled. “A lot of my friends said ‘forget it.’ I left the scene.”

Yee once again devoted his energy to school, earning a masters at San Francisco State University and a Ph.D in child psychology from the University of Hawaii. Along the way, he met his wife, Maxine.

With his new degree, the Yees moved back to San Francisco — and back in with his parents at the Dolores property, where he, Maxine and a family that would grow to four kids would live for more than a decade.

 

Yee worked as a child psychologist for the San Francisco Department of Public Health, starting the city’s first high school mental-health clinic. He went on to become a child psychologist at the Oakland Unified School District, then joined a nonprofit mental health program in San Jose.

In 1986, Yee decided to get active in politics for the first time since college, and ran for the San Francisco School Board. He lost — and that would be the only election he would ever lose. In 1988, he won a seat, and established himself as an advocate for students of color, fighting school closures in minority neighborhoods. He also tried to get the district to modify its harsh disciplinary rules, arguing against mandatory expulsions.

On fiscal issues, though, Yee was a conservative. For his first term, despite the brutal cutbacks of the recession of the late 1980s and early 1990s, he insisted that the district make do with the money it had. His solution to the red ink: Cut waste. Only in 1992, when he was up for re-election, did he acknowledge that the district needed more cash; at that point, he supported a statewide initiative to tax the rich to bring money to the schools.

The sense of fiscal conservatism — of holding the line on taxes, but mandating open and fair contracting procedures and tight financial controls — was a hallmark of much of his political career. When the Guardian endorsed him for re-election to the board in 1992, we wrote that “there’s real value in his continuing vigilance against administrative fat and favoritism in contracts.”

Over the next four years, Yee worked with then-Superintendent Waldemar “Bill” Rojas, a deeply polarizing figure who pushed his own personal theory of “reconstitution” — firing all the staff at low-performing schools — and later was enmeshed in a scandal that led to prison time for a contractor he’d hired. Yee told me he was the only board member to vote against hiring Rojas, but people who were watching the board closely back then say he didn’t always stand up to the superintendent.

He also became what some say was a bit too close with Tim Tronson, a consultant hired by the district as a $1,000-a-day facilities consultant. Tronson wound up getting indicted on 22 counts of grand theft, embezzlement, and conspiracy in a scheme to steal $850,000 from the schools, and was sentenced to four years in state prison.

In 1998, when some school board members wanted to build housing for teachers on property that the district owned in the Sunset, Yee led the opposition — with Tronson’s help. At one meeting at Sunset Elementary School, Yee went so far as to say, according to people present, that “Tim Tronson is my man, and I rely on him for advice.”

Yee acknowledged that he worked closely with Tronson to defeat that housing project. “He was the facilities manager,” Yee explained, “and I said that I trusted his judgment.”

 

Yee has either a great sense of political timing or exceptional luck. He ran for the Board of Supervisors in 1996, facing one of the weakest fields in modern San Francisco history. He was the only Chinese candidate and one of just two Asians (the other, appointed incumbent Michael Yaki, barely squeaked to re-election). In an at at-large election with the top five winning seats, Yee came in third, with 103,000 votes.

He was never a progressive supervisor. In 2000, the Guardian ranked the good votes of what we referred to as Willie Brown’s Board, and Yee scored only 43 percent. He was against campaign finance reform. He supported the brutal gentrification and community displacement represented by the Bryant Square development. He voted to kill a public-power feasibility study and opposed the Municipal Utility District initiative. He opposed a moratorium on uncontrolled live-work development.

In 2002, Yee was one of only three supervisors to oppose Proposition D, a crucial public-power measure that would have broken up PG&E’s monopoly in the city. He stood with PG&E (and then-Sups. Tony Hall and Gavin Newsom) in opposition to the measure, then signed a pro-PG&E ballot argument packed with PG&E lies.

When I asked him about that stand, Yee at first didn’t recall opposing Prop. D, but then said he “stood with labor” on the issue. In fact, the progressive unions didn’t oppose Prop. D at all; the opposition was led by PG&E’s house union, IBEW Local 1245.

Yee was particularly bad on tenant issues. He not only voted to deny city funding for the Eviction Defense Collaborative, which helped low-income tenants fight evictions; he actually tried to get the city to put up money for a free legal fund to help landlords evict their tenants. He opposed a ballot measure limiting condo conversions. He opposed a measure to limit the ability of landlords to pass improvement costs on to their tenants.

In 2001, Yee voted to uphold a Willie Brown veto of legislation to limit tenancies in common, a backdoor way to get around the city’s condo conversion ordinance. Only Hall and Newsom, then the most conservative supervisors on the board, joined Yee. At one point, he started asking whether the city should consider repealing rent control.

He opposed an affordable housing bond in 2002, joining the big landlord groups in arguing that it would raise property taxes. Every tenant group in town supported the measure, Proposition B; every landlord group opposed it.

I asked Yee about his tenant record, and he told me that he now supports rent control. But he said that he was always on the side of homeowners and small landlords, and that property ownership was central to Chinese culture. “I was responding to the Chinese community and the West Side,” he said.

He wasn’t much of an environmentalist, either — at least not in today’s terms. He was one of the only city officials to support a “Critical Car” rally in 1999, aimed at promoting the rights of vehicle drivers (and by implication, criticizing Critical Mass and the bicycle movement).

His record on LGBT issues was mixed. While he supported a counseling program for queer youth when he was on the school board, he also supported JROTC, angering queer leaders who didn’t want a program in the public schools run by, and used as a recruiting tool for, the military, which at that point open discriminated against gay and lesbian people.

 

 

Yee was also one of only two supervisors who voted in 2001 against extending city health benefits to transgender employees.

That was a dramatic moment in local politics. Nine votes were needed to pass the measure, and while eight of the supervisors were in favor, Yee and Hall balked. At one point, Board President Tom Ammiano had to direct the Sheriff’s Office to go roust Sup. Gerardo Sandoval, who was ducking the issue in his office, to provide the crucial ninth vote.

Yee didn’t just vote against the bill. According to one reliable source who was there at the time, Yee spoke to a community meeting out on Ulloa Street in the Sunset and berated his colleagues, quipping that the city should have better things to do than “spend taxpayer money on sex-change operations.”

It was a bit shocking to trans people — Yee had, over the years, befriended some of the most marginalized members of what was already a marginalized community. “There was one person at the rail crying, saying ‘Leland, how could you do this to us,'” Ammiano recalled.

The LGBT community was furious with Yee. “I didn’t speak to him for at least a year,” Gabriel Haaland, one of the city’s most prominent transgender activists, told me.

Yee now says the vote was a mistake — but at the time, he told me, he was under immense pressure. When he voted for the queer youth program, he said, “the elders of the Chinese community ripped me apart. They called my mother’s friends back in the village [where he was born] and said her son was embarrassing the Chinese community.”

That must have been difficult — and he said that “if I had known the pain I had caused, I wouldn’t have voted that way.” But it was hard to miss that pain his vote caused.

On the other hand, people learn from their experiences, attitudes evolve, we all grow up and get smarter, and the way Yee describes it, that’s what happened to him.

In 2006, when he was running for state Senate, Yee met with a group of trans leaders and formally — many now say sincerely — apologized. It was an important gesture that made a lot of his critics feel better about him.

“He didn’t have to do that,” Haaland said. “People change, and he paid for his crime, and that’s genuine enough for me.”

As a former school board member, Yee kept an interest in the schools — but not always a healthy one. At one point, he actually proposed splitting SFUSD into two districts, one on the (poorer) east side of town and one on the (richer) west. “We strongly opposed that,” recalled Margaret Brodkin, who at the time ran Coleman Advocates for Children and Youth. “Eventually he dropped the idea.”

For all the problems, in his time on the Board of Supervisors, Yee developed a reputation for independence from the Brown Machine, which utterly dominated much of city politics in the late 1990s. His weak 43 percent rating on the Guardian scorecard was actually third-best among the supervisors, after Ammiano and the late Sue Bierman.

In 1998, he was one of the leaders in a battle to prevent the owners of Sutro Tower from defying the city’s zoning administrator and placing hundreds of new antennas on Sutro Tower. He, Bierman, and Ammiano were the only supervisors opposing Brown’s crackdown on homeless people in Union Square.

When he ran in the first district elections, in 2000, against two opponents who had Brown’s support and big downtown money, the Guardian endorsed him, noting that while he “can’t be counted on to support worthy legislation … He’s one of only two board members who regularly buck the mayor on the big issues.”

(He never liked district elections, and used to take any opportunity to denounce the system, at times forcing Ammiano to use his position as president to tell Yee to quit dissing the electoral process and get to the point of his speech.)

 

In 2002, the westside state Assembly district seat opened up, and both Yee and his former school board colleague Dan Kelly ran in the Democratic primary. Yee won, and went on to win the general election with only token opposition.

His legislative record in the Assembly wasn’t terribly distinguished. Yee never chaired a policy committee — although he did win a leadership post as speaker pro tem. And he cast some surprisingly bad votes.

In 2003, for example, then-Assemblymember Mark Leno introduced a bill that would have exempted single-room occupancy hotels from the Ellis Act, which allows landlords to evict tenants for no reason. Yee refused to vote for the bill. Leno was furious — he was one vote short of a majority and Yee’s position would have doomed the bill. At the last minute, a conservative Republican who had grown up in an SRO hotel voted in favor.

When he ran for re-election in 2004, we noted: “What’s Leland Yee doing up in Sacramento? We can’t figure it out — and neither, as far as we can tell, can his colleagues or constituents. He’s introduced almost no significant bills — compared, for example, to Assemblymember Mark Leno’s record, Yee’s is an embarrassment. The only high-profile thing he’s done in the past several years is introduce a bill to urge state and local governments to allow feng shui principles in building codes.”

In 2006, Yee decided to move up to the state Senate, and he won handily, beating a weak opponent (San Mateo County Supervisor and former San Francisco cop Mike Nevin) by almost 2-1. His productivity increased significantly in the upper chamber — and in some ways, he moved to the left. He’s begun to support taxes — particularly, an oil severance tax — and when I’ve questioned him, he somewhat grudgingly admits that Prop. 13 deserves review.

He’s done some awful stuff, like trying to sell off the Cow Palace land to private developers. But he has consistently been one of the best voices in the Legislature on open government, and that’s brought him some national attention.

Yee has been a harsh critic of spending practices and secrecy at the University of California, and when UC Stanislaus refused in 2010 to release the documents that would show how much the school was paying Sarah Palin to speak at a fundraiser, Leland flew into action. He not only blasted the university and introduced legislation to force university foundations to abide by sunshine laws; he worked with two Stanislaus students who had found the contract in a dumpster and made headlines all over the country.

He’s fought for student free speech rights and this year pushed a bill mandating that corporations that get tax breaks for job creation prove that they’ve actually created jobs — or pay the tax money back. He’s also won immense plaudits from youth advocates and criminal justice reformers for his bill that would end life-without-parole sentences for offenders under 18.

Along the way, he compiled a 100 percent voting record from the major labor unions, including the California Nurses Association and SEIU, and with the Sierra Club. All three organizations have endorsed him for mayor.

Yee told me that he thinks he’s become more progressive over the years. “My philosophy has shifted,” he said.

Yet when you talk to his colleagues in Sacramento, including Democrats, they aren’t always happy with him. Yee has a tendency to be a bit of a loner — he’s never chaired a policy committee and in some of the most bitter budget fights, he’s refused to go along with the Democratic majority. Yee insists that he’s taken principled stands, declining to vote for budget bills that include deep service cuts. But the reality in Sacramento is that budget bills have until this year required a two-thirds vote, meaning two or three Republicans have had to accept the deal — and losing a Democratic vote has its cost.

“You have to give up all sorts of things, make terrible compromises, to get even two Republicans,” one legislative insider told me. “When a Democrat goes south, you have to find another Republican, and give up even more.”

In other words: It’s easy to take a principled stand, and make a lot of liberal constituencies happy, when you aren’t really trying to make the state budget work.

 

I met Rose Pak on a July afternoon at the Chinatown Hilton. She brought along her own loose tea, in a paper package; the waitress, who clearly knew the drill, took it back to the kitchen to brew. Pak and I have not been on the greatest of terms; she’s called the Guardian all kinds of names, and I’ve had my share of critical things to say about her. But on this day, she was polite and even at times charming.

After we got the niceties out of the way (she told me I was unfair to her, and I told her I didn’t like the way she and Willie Brown played politics), we started talking about Yee. And Pak (unlike some people I interviewed for this story) was happy to speak on the record.

She told me Yee had “no moral character.” She told me she couldn’t trust him. She told me a lot of stories and made a lot of allegations that we both knew neither she nor I could ever prove.

Then we got to talking about the politics of Chinatown and Asians in San Francisco, and a lot of the animosity toward Yee became more clear.

For decades, Chinatown and the institutions and people who live and work there have been the political center of the Chinese community. Nonprofits like the Chinatown Community Development Center have trained several generations of community organizers and leaders. The Chinese Chamber of Commerce, the Six Companies, and other business groups have represented the interests of Chinese merchants. And while the various players don’t always get along, there’s a sense of shared political culture.

“In Chinatown,” Gordon Chin, CCDC’s director, likes to say, “it’s all about personal connections.”

There’s a lively infrastructure of community-service programs, some of which get city money. There’s also a sense that any mayor or supervisor who wants to work with the Chinese community needs to at least touch base with the Chinatown establishment.

Yee doesn’t do that. “He doesn’t give a shit about them,” David Looman, a political consultant who has worked with many Chinese candidates over the years, told me.

Yee’s Asian political base is outside of Chinatown; he told me he sees himself representing more of the Chinese population of the Sunset and Richmond and the growing Asian community in Visitacion Valley and Bayview.

Pak is connected closely to Brown, who Yee often clashed with. For Pak, Brown, and their allies, strong connections to City Hall mean lucrative lobbying deals and public attention to the needs of Chinatown businesses. Then there’s the nonprofit sector.

CCDC and other nonprofits do important, sometimes crucial work, building and maintaining affordable housing, taking care of seniors, fighting for workers rights, and protecting the community safety net. Yee, Pak said, “has never shown any interest in our local nonprofits. We all work together here, and he doesn’t seem to care what we do.” Yee told me he has no desire to see funding cut for any critical social services in any part of town. But he has also made no secret of the fact that he questions the current model of delivering city services through a large network of nonprofits, some of which get millions of taxpayer dollars. And the way Pak sees it, all of that — the nonprofits, the business benefits, the contracts — are all at risk. “If Leland Yee is elected mayor,” she told me, “we are all dead.”

I ran into an old San Francisco political figure the other day, a man who has been around since the 1970s, inside and outside of City Hall, who remains an astute observer of the players and the power relationships in the local scene. At the time we talked, he wasn’t supporting any of the mayoral candidates, but he had a thought for me. “This town,” he said, “is being taken over by a syndicate. Willie Brown is the CEO, and Rose Pak is the COO, and it’s all about money and influence.”

That’s not a pleasant thought — I’ve lived through the era of political machine dominance in this town, and it was awful. In the days when Brown ran San Francisco, politics was a tightly controlled operation; only a small number of people managed to get elected to office without the support of the machine. Developers made land-use policy; gentrification and displacement were rampant; corruption at City Hall turned a lot of San Franciscans off, not only to the political process but to the whole notion that government could be a positive force in society.

A few years ago, I thought those days were over — and to a certain extent, district elections will always make machine politics more difficult. But when I see signs of the syndicate popping up — and I see a candidate like Ed Lee, who’s close friends with Brown, leading the Mayor’s Race — it makes me nervous. And for all his obvious flaws, at least Leland Yee isn’t part of that particular operation. If there’s a better reason to vote for him, I don’t know what it is.

YEE HOME PURCHASE RAISES SUSPICIONS

Rose Pak has a question about Leland Yee. “How,” she asked me, “did the guy manage to buy a million-dollar house on a $30,000 City Hall salary?”

Pak isn’t the only one asking — numerous media reports over the years have examined how Yee raised a family of four and bought a house in the Sunset on very little visible income. And while I’m not usually that interested in the personal finances of political candidates, I decided that it was worth a look.

Here’s what I found: Public records show that in July 1999, Yee and his wife, Maxine, purchased a house on 24th Avenue for $875,000 (it’s now assessed at slightly more than $1 million). At the time, Yee was a San Francisco supervisor, earning a little more than $30,000 a year. (The salary of the supervisors was raised dramatically shortly after Yee left the board and went to the state Assembly.) His wife wasn’t working. And his economic interest statements for that period show no other outside earnings. So the disposable, after-tax income of the entire Yee family couldn’t have been much more than $25,000.

That, by any normal standard, shouldn’t have been enough to float a mortgage that, records show, totaled $516,000. In fact, the interest payments alone on that mortgage alone would total $3,600 a month — more than Yee’s gross income.

Documents in the Assessor’s Office show another paper trail, too. In 1989, Jung H. Lee, Yee’s mother, transferred the deed on a four-unit Dolores St. building where the family had been living to Maxine and Leland Yee — for no money. And a few months before the Yees bought the Sunset house, they took out a $320,000 home-equity loan on that property. That was the down payment on the Sunset property.

Still: At that point, the Yees would have been paying off two mortgages, with a total nut of about $5,000 a month — and supporting four kids, in San Francisco. In 2002, Yee’s economic interest statement’s show some modest income from teaching at Lincoln University — but nowhere near enough to pay that level of expenses.

What happened? Yee explains it this way: “For more than 10 years, we were living rent-free in my parents’ property,” he told me I an interview. “We were a close Chinese family, and my parents provided the food and helped pay for the children’s clothing. So we had almost no expenses and we lived very frugally.”

During that period, Yee was working for the San Francisco Department of Public Health, the Oakland Unified School District, and a San Jose nonprofit, earning, he said, between $50,000 and $90,000 a year. If he saved almost all of that money, he would have had more than a half-million dollars in the bank when he bought the Sunset house.

There’s nothing on any of his economic disclosure forms showing any ownership of stocks or other reportable financial interests during that period, so he wasn’t investing the money. In fact, he says, it was, and is, all in simple savings accounts. A bit unusual for that large a sum of money.

How did he get a mortgage? “Back then,” he said, “banks were willing to lend a lot more freely than they do today.”

Starting in 2003, Yee was in the state Assembly, making a higher salary — but still not much in excess of $100,000 a year. After taxes, he was probably taking home about $75,000 — and $60,000 was going to the two mortgages.

How did he do it? “We have been supplementing our income with our savings,” he said. “We don’t take vacations, we are very careful with our money.” And they clearly aren’t desperate for cash — Yee’s daughter occupies two of the four units in the Dolores St. building they own, but the other two units are vacant.

It’s possible. It’s plausible. But I don’t blame people for wondering how he managed to pull it off. (Tim Redmond, with research assistance by Oona Robertson) 

 

 

 

BIG CORPORATIONS HAVE BACKED YEE

Yee became a prodigious fundraiser in Sacramento — and a lot of the money came from big corporations that had business in the Legislature. And while he has perfect scores from the Sierra Club and the big labor unions, he’s taken tens of thousands of dollars from some of the biggest corporations, agribusiness interests, and polluters in the state. And at times, he’s voted their way.

Since 1993, for example, campaign finance records show Yee has taken more than $20,000 from Chevron, ExxonMobil, Valero, Conoco Phillips, and BP. He’s received another $22,450 from the chemical industry (and industry employees). Most of it came from Clorox, Dow Chemical, and Dupont.

And while the Sierra Club may not have considered it a priority, Sen. Mark Leno has worked hard to pass a bill limiting chemical fire retardants in furniture. In 2008, Yee voted against Leno’s AB 706.

That year he also refused to support a bill that would prohibit the use of the chemical diacetyl in workplaces. The industries that opposed AB 514 (including Bayer, Abbott Laboratories, Pfizer, and Johnson & Johnson) have given Yee a total of more than $60,000.

In 2003, Yee voted against a crucial tenant bill, one that would have prevented the owners of single room occupancy hotels from using the Ellis Act to evict tenants. He received a campaign check for $2,500 from the San Francisco Apartment Association the next day. Landlords in general have given Yee close to $40,000.

Then there’s agribusiness. Yee gets a lot of money from the farming industry, despite the fact that there obviously aren’t many farms in his district. Why, for example, would the California Poultry Association, the California Cattlemen’s Association, and the California Farm Bureau give him money? The Poultry Association’s Bill Mattos told us that Yee “has taken a keen interest in California’s poultry industry.”

Yee also took immense flak from the San Francisco Chronicle and other papers over a 2003 vote against a bill to limit emissions from farm vehicles. In an editorial, the paper wrote that he was “doing dirty work for the lobbyists.” In the end, under immense public pressure, he switched positions and voted for the bill. I asked Yee about all that money from all those bad operators, and he told me — as most politicians will — that campaign cash has never influenced any of his votes.

So why do all these groups give him money? “It’s about whether you will sit down and listen,” Yee said. “I will talk to all sides and at least consider the arguments as a thoughtful human being. Then I vote my conscience.” (Tim Redmond, with research by Oona Robertson)

Gavin Newsom rode into the Mayor’s Office with a campaign to take welfare money away from homeless people. Jeff Adachi’s campaign for mayor is fueled by his attempt to cut city-employee pension costs. It’s an effective tactic: You put an initiative on the ballot and campaign as its sponsor, with your name attached — and while direct fundraising for mayoral candidates is tightly restricted (contribution limits, no corporate money), ballot-measure campaigns can collect unlimited cash, from almost anyone. Pick a popular issue (and attacking homeless people and city workers seems to have a lot of traction these days) and your chances of getting elected get a nice boost.

So why has no candidate running for citywide office in San Francisco ever made tax reform the center of his or her campaign?

I realize that tax reform is boring. Slogans like “shared progressive values” and words like “together” play much better in the focus groups. But think about it: Nearly every major national poll shows that the voters — by a margin of roughly 2-1 — think that tax increases should be part of the solution to the nation’s budget woes. Since San Francisco is way more liberal than the nation as a whole, the margin in this city is probably about 3-1.

Naturally, the poll numbers depend on how you ask the question, so let me suggest a way to frame it that’s entirely honest and consistent with what I suspect most the voters in this city believe. “Since 400 American families now own more wealth than 50 percent of the entire population put together, should San Francisco’s budget problems be solved in part with higher taxes on very rich residents and businesses?”

You might actually get 90 percent support on that one.

Look: Warren Buffett, one of the richest people in the world, recently wrote an opinion piece in the New York Times saying that his class isn’t paying its fair share. Warren Hellman, one of the richest people in San Francisco, told me the same thing a couple of months ago. (In 2006, in a particularly revealing interview, Buffett told economics writer Ben Stein that “there’s class warfare, all right, but it’s my class, the rich class, that’s making war, and we’re winning.”) This is mainstream stuff now.

And I know some of the candidates, particularly Sup. John Avalos, support new taxes on the wealthy, and Assessor Phil Ting wants to repeal parts of Prop. 13. But nobody has ever made this a signature issue. Nobody’s ever made taxing the rich his or her version of Care Not Cash. I’m thinking maybe it’s time.

Deep court cuts favor landlords over tenants

When I read about the latest manifestation of California’s voluntary descent toward Third World status – in this case, the defunding of San Francisco’s civil court system thanks to the deep state budget cuts caused by Republicans – in this morning’s SF Chronicle, I tried to fight through my despair and search for a silver lining.

“With a few exceptions, only criminal cases will go to trial,” the article said, listing those exceptions as mostly family law cases, such as child abuse and neglect and domestic violence.

Hmmm, I thought, is there a way for the average San Franciscan to somehow benefit from this virtual shutdown of our justice system? Then, we at the Guardian had an idea: in a city where two-thirds of residents are renters, perhaps a civil court system that will now take years to get a hearing would be a boon to those contesting eviction proceedings.

Yay, we thought, free rent! And given that it’s mostly the property-owning class that has caused this decimation of basic government services, people who have benefited mightily by having Prop. 13 keep their property taxes artificially low but still block other efforts to increase tax revenues, there seemed to be a certain poetic justice in the possibility that the courts would stop helping them evict their tenants.

So I called San Francisco Tenants Union Director Ted Gullicksen to run our idea past him and find out if we were onto something, but he doused the idea with a bucket of ice-cold reality. It turns out that evictions will continue to move rapidly through the otherwise gutted civil court system (as I would have learned from the Bay Citizen article on the issue).

“Unfortunately, tenants and criminals are being fast tracked,” he told us. And it gets even worse than that because while landlords will still be able to demand action on their evictions within five days, tenants will find years-long delays when they seek justice from landlords acting illegally or unfairly. “While they will move quickly on evictions, they will move slowly on wrongful eviction lawsuits,” Gullicksen said.

Ann Donlan, spokesperson for the San Francisco Superior Court, told us that eviction proceedings will still move quickly because “it’s a statutory requirement.” But, I asked her, as a matter of fairness and equity, why the courts will still delay wrongful eviction suits for years, even though they often deal with the same set of facts as the eviction cases? Doesn’t that bias the courts toward landlords? She told me to please submit my question in writing and she’ll try to get me an answer.

But there really aren’t any good answers to the gross inequities that these deep cuts will cause in the court system, with a 40 percent overall cut being disproportionately focused on the civil side of the equation.

“This is pretty heavy duty,” attorney Stephen Sommers, who handles wrongful termination, civil rights, and other cases on behalf of the little guy. He said many businesses in San Francisco already wantonly disregard their employees’ rights. “They feel like they can get away with murder and now they’ll be highly incentivized to continue that.”

Attorneys facing five-year waits for a trial will be less likely to handle cases on contingent for poor plaintiffs, he said, and people in positions of power of all kind will be more likely to abuse their authority in myriad ways, knowing that their victims will have far less recourse in the courts.

“It’s going to be the wild west out there,” he said. “I wonder, if people can’t turn to the courts, whether they’ll take matters into their own hands and the crime rate will go up.”

But if there is any silver lining for the powerless at all, Gullicksen said the powerful will also find less recourse in an overwhelmed court system. So he suggested, “It might be a good time for a citywide rent strike because they don’t have many resources in the court system anymore.”

Will politicians get veto power over the voters?

Political interest groups of all stripes generally hold the “will of the voters” to be sacrosanct and not something that should be arbitrarily trifled with by mere politicians. Right or wrong, it’s commonly accepted that if voters do something, only they should be able to undo or modify it. And certainly, if that standard is going to be changed, someone ought to put forward a pretty damn good reason for doing so.

Which is why we and other City Hall watchers have been perplexed over these last few months as Sup. Scott Wiener has pushed a ballot measure that would give the Board of Supervisors the power to alter voter-approved measures after three years, which will go before the board tomorrow (Tues/19) for possible placement on the November ballot.

Aside for a general desire to clean up unspecified minor clutter from the city codes, Wiener hasn’t really offered much of a rationale for this big change, or said what laws he has in his sights. That’s caused groups on both the left and the right to view it with great suspicion, for good reason. It’s been amended many times to address the understandable panic about the bedrock principles that it could alter, changing its effective date and going back-and-forth on whether it should apply to voter-initiated measures, finally settling on restricting it to just measures introduced by the board or mayor and taking effect after January 2012.

But as indicated by comments Sup. Sean Elsbernd made at the Rules Committee hearing and with an editorial supporting Wiener’s measure in Friday’s San Francisco Chronicle (which is often a sign of funny business being cooked up downtown), at least some of the rationale is to overturn a trio of progressive fall ballot measures that they don’t like, even before voters have said whether they want them. And that’s not a good sign, no matter how you feel about those measures.

As much as we would all love to empower legislators to go after voter-approved measures that we don’t like – for example, our state would be in much better fiscal shape if the Democrat-controlled Legislature would tweak Prop. 13 – that’s just not how things are done in a democracy. And if undoing every significant progressive reform that voters have approved over the years was suddenly a possibility on any given Tuesday, Wiener will have seriously raised the stakes at City Hall.

With campaign finance laws under attack by conservative judges and rich corporations and individuals wielding ever more power over our elections, the prospect that decades worth of reforms would suddenly be on the table in each district supervisorial race is truly scary. And we’re going to open up this can of worms based simply on the small bureaucratic nips and tucks that Wiener is citing? That just doesn’t make sense. Yup, there’s definitely some funny business going on here.

I’m not prone to agreeing with right-wing nuts from Riverside County, but there’s a county supervisor down there named Jeff Stone who has a dandy idea. He wants to secede.

According to the Los Angeles Times, Stone is proposing that 13 counties in the southland and inland empire split off and become their own state, which would be called South California. We’re talking everything south of Madera, with the coastal counties (and Los Angeles) left behind. A real conservative haven of low taxes and limited regulation.

And I say: Go for it, pal. I’m completely with you.

Imagine what would happen if Supervisor Stone got his way. There would be no more budget paralysis in the California Legislature. Democrats would control two-thirds of both houses and could pass a budget that included higher taxes on the rich and big corporations. Candidates for governor wouldn’t have to worry about getting votes from the conservative parts of the state, so they could talk more honestly about the major issues. Same-sex marriage would pass the first week. Pot would be legal. The death penalty would be gone in a year or two.

It might take a while longer to amend Prop. 13, but with the ability to raise revenue instead of just cutting, California could begin to fund the schools adequately, rebuild the state university system, and move forward with projects like high-speed rail.

And let’s remember: those counties that want to leave? They elect representatives who won’t vote for taxes — but they are the biggest beneficiaries of state revenues. The northern and coastal counties, the more liberal ones, pay more in taxes than we get in services. Our taxpayers are subsidizing their tax haters.

So go on — leave. We’ll keep our money here.

Now, just to our south and east would be a train wreck of a state with few public services — but South California would still be part of America, so people could move north without worrying about immigration papers. I’d propose that we set up a state fund to resettle refugees from Republicanland.

And maybe, after a while, the people who have to live with crappy schools and crumbling roads will look across the border and say, Why do they have it so good? And maybe they’ll start to think differently about the role of government.

A cheap shot at Tom Ammiano

Elizabeth Lesly Stevens has done some good work on the insanity of Prop. 13. Check out this, and this, and this — all of which say, more or less, that rich people are getting a great deal under the tax law, and aren’t paying their share.


Correct. Well said. Good points.


So why did she decide to take a cheap shot at the one local politician who’s actually trying to do something about it?


A column that ran in the New York Times July 3 talks about Assemblymember Tom Ammiano, who is leading an effort to reform the worst parts of Prop. 13 — the loopholes that allow commercial property to avoid reassessment, costing the state and local government tens of millions of dollars or more a year.


And what does Stevens, who based on her past writing clearly agrees this is a problem, have to say? Well, she says Ammiano is courageous for taking on the issue — then tweaks him for having a low, Prop. 13-protected assessment on his own house in Bernal Heights:


Yet the feisty Mr. Ammiano is quiet as a church mouse about altering the residential protections of Proposition 13 — of which he is a signal beneficiary.


Mr. Ammiano, who is also a comedian, pays just $530 a year in taxes on the Bernal Heights home he has owned since 1974. As far as the city and Proposition 13 are concerned, his house is worth $45,600. Zillow estimates its current worth at $645,000. At that value, the tax would be about $7,500.


That’s all perfectly true. It’s also true that Ammiano is (a) not rich and (b) has spoken for years of the need to reform all of Prop. 13, not just the commercial loophole he’s going after right now. I’ve known Ammiano a long time — and I can tell you that, since the days he was on the San Francisco School Board in the 1990s, he has consistently favored amending Prop. 13, including the residential benefits that he now enjoys.


So he hasn’t been “quiet as a church mouse.” He’s been pretty loud, for a pretty long time.


He also knows, as does Stevens, that repealing Prop. 13 entirely is a political nonstarter. Not going to happen. Too bad, but even talking about it is a waste of time right now. So Ammiano’s going after the only reform he has a chance of winning — and, by the way, attacking the most outrageous loophole.


I don’t think Stevens meant this to be a hit piece or anything; she, and her editors, are just fascinated by this strange law we Californians call Prop. 13. But when I read her piece, what I got out of it was: Here’s a guy who wants to make other people pay more taxes — but he’s not going to do anything about his own tax breaks. I just don’t think that’s terribly true, or terribly fair.
