OPENING

Ajami You may recognize the title of Yaron Shoni and Scandar Copti’s debut collaboration as one of five films nominated for a 2010 Academy Award in the Foreign Category. Though it didn’t bring home the grand prize, Ajami remains a complex and affecting story about desperation and its consequences in a religiously-mixed town in Israel. As we follow the lives of four of Ajami’s residents the narrative shifts perspective almost maddeningly, switching characters seemingly at the height of each story’s action. But once all of the stories fully intersect, the final product has the distinction of feeling both meticulously calculated and completely natural. I was most impressed to learn that Shani and Copti prepared their actors with improvised role-playing rather than scripts. By withholding what was going to happen in a scene before shooting, we are treated to looks of surprise and emotion on actor’s faces that never feel unnatural. Attaining such a level of realism may be Ajami‘s crowning achievement; it can’t have been easy to make a foreign world feel so familiar. (2:00) Embarcadero. (Galvin)

*The Art of the Steal How do you put a price on something that’s literally priceless? The Art of the Steal takes an absorbing look at the Barnes Collection, a privately-amassed array of Post-Impressionist paintings (including 181 Renoirs) worth billions — and the many people and corporate interests who schemed to control it. Founder Albert C. Barnes was an singular character who took pride in his outsider status; he housed his art in a specially-constructed gallery far from downtown Philadelphia’s museum scene, and he emphasized education and art appreciation first and foremost. But he had no heirs, and after his death in 1951, opportunists began circling his massive collection; the slippery political and legal dealings that have unfolded since then are nearly as jaw-dropping as Barnes’ prize paintings. Philly documentarian Don Argott has a doozy of a subject here, and his skillful, even suspenseful film does it justice. (1:41) Embarcadero, Shattuck, Smith Rafael. (Eddy)

*The Good Guy Romantic comedies often have very simple premises predicated on familiarity — you know why you go to see them, and they make sure to deliver. Much of the early goings of The Good Guy feel clichéd, but as it turns out, that’s kind of the point. Tommy (Scott Porter), a charming Wall Street investment banker, has been dating Beth (Alexis Bledel), and they’re taking things slow and sweet. When he loses one of his top sellers to another firm, Tommy decides to be a nice guy and give bumbling temp Daniel (Bryan Greenberg) a chance to shine; he also takes the time to teach him how to dress and pick up girls. But when Daniel decides to use his newfound skills on Beth &ldots; well, you see the triangle coming a mile away. How it all unfolds, however, proves far less obvious. In his writing-directing debut, Julio Depietro delivers what is very much a writer’s film, an experiment in form and expectation. Attempts to capture the culture of a Wall Street investment firm fare less well, but as a skewing of movie archetypes and presumptions, The Good Guy is surprisingly satisfying. It won’t change the rom-com game, but it’s something a little different in a genre that could use a kick in the pants. (1:31) Opera Plaza. (Galvin)

Green Zone Nope, it’s not a new Jason Bourne movie, but it is an action thriller directed by Paul Greengrass and starring Matt Damon. (1:55) California, Piedmont.

*"Academy Award-Nominated Short Films: Animated" Just because it’s animation doesn’t mean it’s just for kids. Like the live-action Oscar-nominated shorts, this year’s animated selections have got range, from the traditionally child-friendly to downright vulgar. Skewing heavily towards CG fare, the shorts vary from a Looney Tunes-style chase for an elderly woman’s soul (The Lady and the Reaper) to the Wallace and Gromit BBC special, A Matter of Loaf and Death. Most entertaining by far is Logorama, an action-packed tale set in a world populated by familiar trademarked logos. Any film that casts the Michelin man as a garbage-mouthed cop on the case of a renegade Ronald McDonald deserves to win all the awards in the universe. (1:35) Shattuck. (Galvin)

*"Academy Award-Nominated Short Films: Live Action" Aren’t you tired of wondering what all the fuss is about when the Academy awards their Oscar for Best Short? In an effort to give audiences a chance to play along, Shorts International is screening these less-seen works together. Though one or two of the five nominated films threaten to adhere to the Academy’s penchant for either heartbreaking or heartwarming, the majority are surprisingly oddball picks. Perhaps most odd of all is Denmark/U.S. submission The New Tenants. Feeling a tad forced but no less funny for it, Tenants draws on celebrities like Vincent D’Onofrio and comedian Kevin Corrigan to bring life to this surreal adaptation by Anders Thomas Jensen (2006’s After the Wedding). My pick would be Sweden’s gloriously goofy Instead of Abracadabra, which stars a stay-at-home slacker as he puts on a magic show for his father’s birthday. Obviously, some selections are going to be better than others, but hey, they’re shorts. If you don’t like one, just wait 10 minutes and you’ll find yourself somewhere completely different. Alice in Wonderland Tim Burton’s take on the classic children’s tale met my mediocre expectations exactly, given its months of pre-release hype (in the film world, fashion magazines, and even Sephora, for the love of brightly-colored eyeshadows). Most folks over a certain age will already know the story, and much of the dialogue, before the lights go down and the 3-D glasses go on; it’s up to Burton and his all-star cast (including numerous big-name actors providing voices for animated characters) to make the tale seem newly enthralling. The visuals are nearly as striking as the CG, with Helena Bonham Carter’s big-headed Red Queen a particularly marvelous human-computer creation. But Wonderland suffers from the style-over-substance dilemma that’s plagued Burton before; all that spooky-pretty whimsy can’t disguise the film’s fairly tepid script. Teenage Alice (Mia Wasikowska) displaying girl-power tendencies is a nice, if not surprising, touch, but Johnny Depp’s grating take on the Mad Hatter will please only those who were able to stomach his interpretation of Willy Wonka. Avatar James Cameron’s Avatar takes place on planet Pandora, where human capitalists are prospecting for precious unobtainium, hampered only by the toxic atmosphere and a profusion of unfriendly wildlife, including the Na’vi, a nine-foot tall race of poorly disguised cliches. When Jake Sully (Sam Worthington), a paraplegic ex-marine, arrives on the planet, he is recruited into the "Avatar" program, which enables him to cybernetically link with a part-human, part-Na’vi body and go traipsing through Pandora’s psychedelic underbrush. Initially designed for botanical research, these avatars become the only means of diplomatic contact with the bright-blue natives, who live smack on top of all the bling. The special effects are revolutionary, but the story that ensues blends hollow "noble savage" dreck with events borrowed from Dances With Wolves (1990) and FernGully: The Last Rainforest (1992). When Sully falls in love with a Na’vi princess and undergoes a spirit journey so he can be inducted into the tribe and fight the evil miners, all I could think of was Kevin Bacon getting his belly sliced in The Air Up There (1994). The Blind Side When the New York Times Magazine published Michael Lewis’ article "The Ballad of Big Mike" — which he expanded into the 2006 book The Blind Side: Evolution of a Game — nobody could have predicated the cultural windfall it would spawn. Lewis told the incredible story of Michael Oher — a 6’4, 350-pound 16-year-old, who grew up functionally parentless, splitting time between friends’ couches and the streets of one of Memphis’ poorest neighborhoods. As a sophomore with a 0.4 GPA, Oher serendipitously hitched a ride with a friend’s father to a ritzy private school across town and embarked on an unbelievable journey that led him into a upper-class, white family; the Dean’s List at Ole Miss; and, finally, the NFL. The film itself effectively focuses on Oher’s indomitable spirit and big heart, and the fearless devotion of Leigh Anne Tuohy, the matriarch of the family who adopted him (masterfully played by Sandra Bullock). While the movie will delight and touch moviegoers, its greatest success is that it will likely spur its viewers on to read Lewis’ brilliant book. (2:06) Oaks. (Daniel Alvarez)

Brooklyn’s Finest "Really? I mean, really?" asked the moviegoer beside me as the final freeze-frame of Brooklyn’s Finest slapped our eyeballs. Yes, that’s the sound of letdown, despite the fact that Brooklyn’s Finest initially resembled a promisingly gritty juggling act in the mode of The Wire and Cop Land (1997), Taxi Driver (1976) and Training Day (2001). Bitter irony flows from the title — and from the lives, loves, bad habits, pressure-cooker stress, and unavoidable moral dilemmas of three would-be everyday cops, all occupying several different rungs on a food chain where right and wrong have an unpleasant way of switching sides. Eddie (Richard Gere) is the veteran officer just biding his time till he gets his pension, all while comforting himself with the meager sensuous attentions of hooker Chantel (Shannon Kane). Sal (Ethan Hawke) is the bad detective, stealing from the dealers to fund a dream home for his growing family with Angela (Lili Taylor). Tango (Don Cheadle) is the undercover detective who has cultivated friendships with dealers like Caz (Wesley Snipes) and sacrificed his marriage for a long-promised promotion from his lieutenant (Will Patton) and his superior (Ellen Barkin, in likely the most misogynist portrayal of a lady with a badge to date). You spend most of Brooklyn’s Finest waiting for these cops to collide in the most unfortunate, messiest way possible, but instead the denouement leaves will leave one wondering about unresolved threads and feeling vaguely unsatisfied. In any case, director Antoine Fuqua and company seem to pride themselves on their tough-minded if at times cartoonish take on law enforcement, with Hawke in particular turning in a memorably OTT and anguished performance. Cop Out I think there was a plot to Cop Out — something involving a stolen baseball card and a drug ring and Jimmy (Bruce Willis) trying to pay for his daughter’s wedding. Frankly, it’s irrelevant. Kevin Smith’s take on the buddy cop genre, which partners Willis with Tracy Morgan, is more a string of dick jokes and toilet humor than anything else. Not that there’s anything wrong with that. Sometimes it’s nice to sit back and turn off your brain, as Morgan’s Paul describes his bowel movements or when hapless thief Dave (Seann William Scott) begins imitating everything our heroes say. At the same time, Cop Out is easily forgettable: Smith directed the film, but writing duties went to the Cullen Brothers of TV’s Las Vegas. All judgments about that series aside, the script lacks Smith’s trademark blend of heart and vulgarity. Even Mallrats (1995) had a beginning, a middle, and a satisfying end. Without Smith as auteur, Cop Out is worth a few laughs but destined for the bargain bin. (1:50) 1000 Van Ness. (Peitzman)

The Crazies Disease and anti-government paranoia dovetail in this competent yet overwhelmingly non-essential remake of one of George A. Romero’s second-tier spook shows. In a small Iowa hamlet overseen by a benevolent sheriff (Timothy Olyphant) and his pregnant wife (Radha Mitchell), who’s also the town doctor, a few odd incidents snowball into all-out chaos when a mysterious, unmarked plane crashes into the local water supply. Before long, the few residents who aren’t acting like homicidal maniacs are rounded up by an uber-aggressive military invasion. Though our heroes convey frantic panic as they try to figure out what the hell is going on, The Crazies never achieves full terror mode. It’s certainly watchable, and even enjoyable at times. But memorable? Not in the slightest. (1:41) 1000 Van Ness. (Eddy)

Crazy Heart "Oh, I love Jeff Bridges!" is the usual response when his name comes up every few years for Best Actor consideration, usually via some underdog movie no one saw, and the realization occurs that he’s never won an Oscar. The oversight is painful because it could be argued that no leading American actor has been more versatile, consistently good, and true to that elusive concept "artistic integrity" than Bridges over the last 40 years. It’s rumored Crazy Heart was slotted for cable or DVD premiere, then thrust into late-year theater release in hopes of attracting Best Actor momentum within a crowded field. Lucky for us, this performance shouldn’t be overlooked. Bridges plays "Bad" Blake, a veteran country star reduced to playing bars with local pickup bands. His slide from grace hasn’t been helped by lingering tastes for smoke and drink, let alone five defunct marriages. He meets Jean (Maggie Gyllenhaal), freelance journalist, fan, and single mother. They spark; though burnt by prior relationships, she’s reluctant to take seriously a famous drunk twice her age. Can Bad handle even this much responsibility? Meanwhile, he gets his "comeback" break in the semi-humiliating form of opening for Tommy Sweet (Colin Farrell) — a contemporary country superstar who was once Bad’s backup boy. Tommy offers a belated shot at commercial redemption; Jean offers redemption of the strictly personal kind. There’s nothing too surprising about the ways in which Crazy Heart both follows and finesses formula. You’ve seen this preordained road from wreckage to redemption before. But actor turned first-time director Scott Cooper’s screenplay honors the flies in the windshield inherited from Thomas Cobb’s novel — as does Bridges, needless to say. *An Education The pursuit of knowledge — both carnal and cultural — are at the tender core of this end-of-innocence valentine by Danish filmmaker Lone Scherfig (who first made her well-tempered voice heard with her 2000 Dogme entry, Italian for Beginners), based on journalist Lynn Barber’s memoir. Screenwriter Nick Hornby breaks further with his Peter Pan protagonists with this adaptation: no man-boy mopers or misfits here. Rather, 16-year-old schoolgirl Jenny (Carey Mulligan) is a good girl and ace student. It’s 1961, and England is only starting to stir from its somber, all-too-sober post-war slumber. The carefully cloistered Jenny is on track for Oxford, though swinging London and its high-style freedoms beckon just around the corner. Ushering in those freedoms — a new, more class-free world disorder — is the charming David (Peter Sarsgaard), stopping to give Jenny and her cello a ride in the rain and soon proffering concerts and late-night suppers in the city. He’s a sweet-faced, feline outsider: cultured, Jewish, and given to playing fast and loose in the margins of society. David can see Jenny for the gem she is and appreciate her innocence with the knowing pleasure of a decadent playing all the angles. The stakes are believably high, thanks to An Education‘s careful attention to time and place and its gently glamored performances. Scherfig revels in the smart, easy-on-eye curb appeal of David and his friends while giving a nod to the college-educated empowerment Jenny risks by skipping class to jet to Paris. And Mulligan lends it all credence by letting all those seduced, abandoned, conflicted, rebellious feelings flicker unbridled across her face. (1:35) SF Center, Shattuck, Smith Rafael. (Chun)

Formosa Betrayed The turbulent modern history of Taiwan is certainly deserving of increased international attention, but writer-producer Will Tao’s strategy of structuring Formosa Betrayed as a political thriller is too often at odds with imparting facts and information. Set in the early 80s, the film thrusts viewers into an unraveling government conspiracy that has FBI agent Jake Kelly (James Van Der Beek) trailing the suspected murderers of a Chicago professor to Taipei. Initially, selling Dawson’s Creek alum Van Der Beek as an FBI agent seems a strange choice, but undoubtedly his name will fill seats, and Formosa Betrayed is shooting for maximum awareness. There are some scenes of real tension, but just when you are beginning to get wrapped up in the inherent drama of conspiracy and murder, the suspense is interrupted by a long-winded bout of soapboxing. Formosa Betrayed might enlighten some audiences about Taiwan’s controversial history, but it too often does so at the expense of its own watchability. You start to wonder why Tao didn’t just make a documentary. (1:43) SF Center. (Galvin)

*The Ghost Writer Roman Polanski’s never-ending legal woes have inspired endless debates on the interwebs and elsewhere; they also can’t help but add subtext to the 76-year-old’s new film, which is chock full o’ anti-American vibes anyway. It’s also a pretty nifty political thriller about a disgraced former British Prime Minister (Pierce Brosnan) who’s hanging out in his Martha’s Vineyard mansion with his whip-smart, bitter wife (Olivia Williams) and Joan Holloway-as-ice-queen assistant (Kim Cattrall), plus an eager young biographer (Ewan McGregor) recently hired to ghost-write his memoirs. But as the writer quickly discovers, the politician’s past contains the kinds of secrets that cause strange cars with tinted windows to appear in one’s rearview mirror when driving along deserted country roads. Polanski’s long been an expert when it comes to escalating tension onscreen; he’s also so good at adding offbeat moments that only seem tossed-off (as when the PM’s groundskeeper attempts to rake leaves amid relentless sea breezes) and making the utmost of his top-notch actors (Tom Wilkinson and Eli Wallach have small, memorable roles). Though I found The Ghost Writer‘s ZOMG! third-act revelation to be a bit corny, I still didn’t think it detracted from the finely crafted film that led up to it. The Hurt Locker When the leader of a close-knit U.S. Army Explosive Ordnance Disposal squad is killed in action, his subordinates have barely recovered from the shock when they’re introduced to his replacement. In contrast to his predecessor, Sgt. James (Jeremy Renner) is no standard-procedure-following team player, but a cocky adrenaline junkie who puts himself and others at risk making gonzo gut-instinct decisions in the face of live bombs and insurgent gunfire. This is particularly galling to next-in-command Sanborn (Anthony Mackie). An apolitical war-in-Iraq movie that’s won considerable praise for accuracy so far from vets (scenarist Mark Boal was "embedded" with an EOD unit there for several 2004 weeks), Kathryn Bigelow’s film is arguably you-are-there purist to a fault. While we eventually get to know in the principals, The Hurt Locker is so dominated by its seven lengthy squad-mission setpieces that there’s almost no time or attention left for building character development or a narrative arc. The result is often viscerally intense, yet less impactful than it would have been if we were more emotionally invested. Assured as her technique remains, don’t expect familiar stylistic dazzle from action cult figure Bigelow (1987’s Near Dark, 1989’s Blue Steel, 1991’s Point Break) — this vidcam-era war movie very much hews to the favored current genre approach of pseudo-documentary grainy handheld shaky-cam imagery. *The Last Station Most of the buzz around The Last Station has focused on Helen Mirren, who takes the lead as the Countess Sofya, wife of Leo Tolstoy (Christopher Plummer). Mirren is indeed impressive — when is she not? — but there’s more to the film than Sofya’s Oscar-worthy outbursts. The Last Station follows Valentin Bulgakov (James McAvoy), hired as Tolstoy’s personal secretary at the end of the writer’s life. Valentin struggles to reconcile his faith in the anarchist Christian Tolstoyan movement with his sympathy for Sofya and his budding feelings for fellow Tolstoyan Masha (Kerry Condon). For the first hour, The Last Station is charming and very funny. Once Tolstoy and Sofya’s relationship reaches its most volatile, however, the tone shifts toward the serious — a trend that continues as Tolstoy falls ill. After all the lighthearted levity, it’s a bit jarring, but the solid script and accomplished cast pull The Last Station together. Paul Giamatti is especially good as Vladimir Chertkov, who battles against Sofya for control of Tolstoy’s will. You’ll never feel guiltier for putting off War and Peace. *Leonard Cohen: Live at the Isle of Wight 1970 The dawn of the Me Decade saw the largest-ever music festival to that date —albeit one that was such a logistical, fiscal and hygenic disaster that it basically killed the development of similar events for years. This was the height of "music should be free" sentiments in the counterculture, with the result that many among the estimated six to eight hundred thousand attendees who overwhelmed this small U.K. island showed up without tickets, refused to pay, and protested in ways that included tearing down barrier walls and setting fires. It was a bummer, man. But after five days of starry acts often jeered by an antsy crowd — including everyone from Joni, Hendrix, Dylan, Sly Stone, the Who and the Doors to such odd bedfellows as Miles Davis, Tiny Tim, Voices of East Harlem, Supertramp, and Gilberto Gil — Canadian troubador Cohen appeared at 4 a.m. on a Monday to offer balm. Like director Murray Lerner’s 1995 Message to Love, about the festival as a whole, this footage has been shelved for decades, but it bounces right back from the dead — albeit soothingly. Cohen seems blissed out, pupils like black marbles, his between-song musings are as poetical as those fascinating lyrics, and his voice is suppler than the rasp it would soon become. Kris Kristofferson, Judy Collins, Joan Baez, and bandmate Bob Johnson offer reflections 40 years later. But the main attraction is obviously Cohen, who is magnetic even if an hour of (almost) nothing but ballads reveals how stylistically monotone his songwriting could be. (1:04) Roxie. (Harvey)

*The Most Dangerous Man in America: Daniel Ellsberg and the Pentagon Papers For many, Daniel Ellsberg is a hero — a savior of American First Amendment rights and one of the most outspoken opponents of the Vietnam war. But as this documentary (recently nominated for an Academy Award) shows, it’s never an an easy decision to take on the U.S. government. Ellsberg himself narrates the film and details his sleepless nights leading up to the leak of the Pentagon Papers — the top secret government study on the Vietnam war — to the public. Though there are few new developments in understanding the particulars of the war or the impact the release of the Papers had on ending the conflict, the film allows audiences to experience the famous case from Ellsberg’s point of view, adding a fresh and poignantly human element to the events; it’s a political documentary that plays more like a character drama. Whether you were there when it happened or new to the story, there is something to be appreciated from this tale of a man who fell out of love with his country and decided to do something about it. *North Face You’ll never think of outerwear the same way again — and in fact you might be reaching for your fleece and shivering through the more harrowing climbing scenes of this riveting historical adventure based on a true tale. Even those who consider themselves less than avid fans of outdoor survival drama will find their eyes frozen, if you will, on the screen when it comes to this retelling/re-envisioning of this story, legendary among mountaineers, of climbers, urged on by Nazi propaganda, to tackle the last "Alpine problem." At issue: the unclimbed north face of Switzerland’s Eiger, a highly dangerous and unpredictable zone aptly nicknamed "Murder Wall." Two working-class friends, Toni Kurz (Benno Fürmann of 2008’s Jerichow) and Andi Hinterstoisser (Florian Lukas) — here portrayed as climbing fiends driven to reach summits rather than fight for the Nazis — take the challenge. There to document their achievement, or certain death, is childhood friend and Kurz’s onetime sweetheart Luise (Johanna Wokalek, memorable in 2008’s The Baader Meinhof Complex), eager to make her name as a photojournalist while fending off the advances of an editor (Ulrich Tukur) seeking to craft a narrative that positions the contestants as model Aryans. But the climb — and the Eiger, looming like a mythical ogre — is the main attraction here. Filmmaker Philipp Stölzl brings home the sheer heart-pumping exhilaration and terror associated with the sport — and this specific, legendarily tragic climb — by shooting in the mountains with his actors and crew, and the result goes a way in redeeming an adventure long-tainted by its fascist associations. *Percy Jackson and the Olympians: The Lightning Thief It would be easy to dismiss Percy Jackson and the Olympians: The Lightning Thief as an unabashed Harry Potter knock-off. Trio of kids with magic powers goes on a quest to save the world in a Chris Columbus adaptation of a popular young adult series — sound familiar? But The Lightning Thief is sharp, witty, and a far cry from Columbus’ joyless adaptation of Harry Potter and the Sorcerer’s Stone (2001). Logan Lerman stars as Percy Jackson, the illegitimate son of Poseidon and Catherine Keener. Once he learns his true identity at Camp Half-Blood, he sets off on a quest with his protector, a satyr named Grover, and potential love interest Annabeth, daughter of Athena. Along the way, they bump into gods and monsters from Greek mythology — with a twist. Think Percy using his iPhone to fight Medusa (Uma Thurman), or a land of the Lotus-Eaters disguised as a Lady Gaga-blasting casino. A worthy successor to Harry Potter? Too soon to say, but The Lightning Thief is at least a well-made diversion. (1:59) 1000 Van Ness. (Peitzman)

*Precious: Based on the Novel Push By Sapphire This gut-wrenching, little-engine-that-could of a film shows the struggles of Precious, an overweight, illiterate 16-year-old girl from Harlem. Newcomer Gabourey Sidibe is so believably vigilant that her performance alone could bring together the art-house viewers as well as take the Oscars by storm. But people need to actually go and experience this film. While Precious did win Sundance’s Grand Jury and Audience Award awards this year, there is a sad possibility that filmgoers will follow the current trend of "discussing" films that they’ve actually never seen. The daring casting choices of comedian Mo’Nique (as Precious’ all-too-realistically abusive mother) and Mariah Carey (brilliantly understated as an undaunted and dedicated social counselor) are attempts to attract a wider audience, but cynics can hurdle just about anything these days. What’s most significant about this Dancer in the Dark-esque chronicle is how Damien Paul’s screenplay and director Lee Daniels have taken their time to confront the most difficult moments in Precious’ story –- and if that sounds heavy-handed, so be it. Stop blahging for a moment and let this movie move you. (1:49) Roxie, Shattuck. (Jesse Hawthorne Ficks)

*Prodigal Sons Some of the best documentaries in recent years have been hijacked by their subject — or even by another subject the filmmaker wasn’t planning on. Prodigal Sons was supposed to be Kimberly Reed’s story about a high-school quarterback, basketball captain, class president, and valedictorian born to a family of Montana farmers, returning for a reunion 20 years later — albeit as a fully transitioned male-to-female transgender person attending with her female lover. That would have made for an interesting movie. What makes Sons a fascinating one is that Reed finds the camera focus stolen almost right away by a crisis in progress. Its name is Marc, adopted "problem child" of the McKerrow family (Kimberly changed her surname post-op). It’s not so much that Marc grabs the spotlight out of a jealous need for attention, though that may be a factor. It’s that he’s still trapped in a sibling relationship that for her ceased to exist — at least in its original form — decades ago. Running a gamut from harrowing to miraculous, the remarkable Prodigal Sons grows stranger than fiction when abandoned-at-birth Marc discovers something jaw-dropping about his ancestry. Suffice it to say, this results in a trip to Croatia and biological link to some of Hollywood’s starriest legends. If Kimberly’s story is about repression forcing a mentally healthy transformation, Marc wrests us away from that inspirational self-portrait. He renders Sons a challenging, head-on glimpse of mental illness with no easy answers in sight. (1:26) Lumiere, Shattuck. (Harvey)

*A Prophet Filmmaker Jacques Audiard has described his new film, A Prophet, as "the anti-Scarface." Yet much like Scarface (1983), A Prophet bottles the heady euphoria that chases the empowerment of the powerless and the rise of the long-shot loner on the margins. In its almost-Dickensian attention to detail, devotion to its own narrative complexity, and passion for cinematic poetry, A Prophet rises above the ordinary and, through the prism of genre, finds its own power. The supremely opportunistic, pragmatically Machiavellian intellectual and spiritual education of a felon is the chief concern of here. Played by Tahar Rahim with guileless, open-faced charisma, Malik is half-Arab and half-Corsican — and distrusted or despised by both camps in the pen. When he lands in jail for his six-year sentence, he’s 19, illiterate, friendless, and vulnerable. His deal with the devil — and means of survival — arrives with Reyeb (Hichem Yacoubi), temporarily locked up before his testifies against the mob. Corsican boss Cesar Luciani (Niels Arestrup) wants him dead, and Malik is tagged to penetrate Reyeb’s cell with a blade hidden in mouth. After Malik’s gory rebirth, it turns out that the teenager’s a seer in more ways than one. From his low-dog position, he can eyeball the connections linking the drugs entering the prison to those circulating outside, as well as the machinations intertwining the Arab and Corsican syndicates. It’s no shock that when Cesar finds his power eroding and arranges prison leaves for his multilingual crossover star that Malik serves not only his Corsican master, but also his own interests, and begins to build a drug empire rivaling his teacher’s. Throughout his pupil’s progress, Audiard demonstrates a way with Henri Cartier-Bresson’s decisive moment, and when Malik finally breaks with his Falstaffian patriarch, it makes your heart skip a beat in a move akin to the title of the director’s last film. This Eurozone/Obama-age prophet is all about the profit — but he’s imbued with grace, even while gaming for ill-gotten gain. (2:29) Embarcadero, Shattuck, Smith Rafael. (Chun)

Shutter Island Director Martin Scorsese and muse du jour Leonardo DiCaprio draw from oft-filmed novelist Dennis Lehane (2003’s Mystic River, 2007’s Gone Baby Gone) for this B-movie thriller that, sadly, offers few thrills. DiCaprio’s a 1950s U.S. marshal summoned to a misty island that houses a hospital for the criminally insane, overseen by a doctor (Ben Kingsley) who believes in humane, if experimental, therapy techniques. From the get-go we suspect something’s not right with the G-man’s own mind; as he investigates the case of a missing patient, he experiences frequent flashbacks to his World War II service (during which he helped liberate a concentration camp), and has recurring visions of his spooky dead wife (Michelle Williams). Whether or not you fall for Shutter Island‘s twisty game depends on the gullibility of your own mind. Despite high-quality performances and an effective, if overwrought, tone of certain doom, Shutter Island stumbles into a third act that exposes its inherently flawed and frustrating storytelling structure. If only David Lynch had directed Shutter Island — it could’ve been a classic of mindfuckery run amok. Instead, Scorsese’s psychological drama is sapped of any mystery whatsoever by its stubbornly literal conclusion. (2:18) California, 1000 Van Ness, Sundance Kabuki. (Eddy)

A Single Man In this adaptation of Christopher Isherwood’s 1964 novel, Colin Firth plays George, a middle-aged gay expat Brit and college professor in 1962 Los Angeles. Months after the accidental death of Jim (Matthew Goode), his lover for 16 years, George still feels worse than bereft; simply waking each morning is agony. So on this particular day he has decided to end it all, first going through a series of meticulous preparations and discreet leave-takings that include teaching one last class and having supper with the onetime paramour (Julianne Moore) turned best friend who’s still stuck on him. The main problem with fashion designer turned film director Tom Ford’s first feature is that he directs it like a fashion designer, fussing over surface style and irrelevant detail in a story whose tight focus on one hard, real-world thing — grief — cries for simplicity. Not pretentious overpackaging, which encompasses the way his camera slavers over the excessively pretty likes of Nicholas Hoult as a student and Jon Kortajarena as a hustler, as if they were models selling product rather than characters, or even actors. (In fact Kortajarena is a male supermodel; the shocker is that Hoult is not, though Hugh Grant’s erstwhile About a Boy co-star is so preening here you’d never guess.) Eventually Ford stops showing off so much, and A Single Man is effective to the precise degree it lets good work by Goode, Moore and especially the reliably excellent Firth unfold without too much of his terribly artistic interference. Up in the Air After all the soldiers’ stories and the cannibalism canards of late, Up in the Air‘s focus on a corporate ax-man — an everyday everyman sniper in full-throttle downsizing mode — is more than timely; it’s downright eerie. But George Clooney does his best to inject likeable, if not quite soulful, humanity into Ryan Bingham, an all-pro mileage collector who prides himself in laying off employees en masse with as few tears, tantrums, and murder-suicide rages as possible. This terminator’s smooth ride from airport terminal to terminal is interrupted not only by a possible soul mate, fellow smoothie and corporate traveler Alex (Vera Farmiga), but a young tech-savvy upstart, Natalie (Anna Kendrick), who threatens to take the process to new reductionist lows (layoff via Web cam) and downsize Ryan along the way. With Up in the Air, director Jason Reitman, who oversaw Thank You for Smoking (2005) as well as Juno (2007), is threatening to become the bard of office parks, Casual Fridays, khaki-clad happy hours, and fly-over zones. But Up in the Air is no Death of a Salesman, and despite some memorable moments that capture the pain of downsizing and the flatness of real life, instances of snappily screwball dialogue, and some more than solid performances by all (and in particular, Kendrick), he never manages to quite sell us on the existence of Ryan’s soul. Valentine’s Day Genre moviemaking loves it a gimmick — and nothing gets more greeting-card gimmicky or sell-by-date corny than the technique of linking holidays and those mandatory date nights out. You’re shocked that nobody thought of this chick flick notion sooner. Valentine’s Day is no My Bloody Valentine (1981, 2009) — it aspires to an older, more yupscale lady’s choice-crowd than the screaming teens that are ordinarily sought out by horror flicks. And its A-list-studded cast — including Oscar winners Julia Roberts, Jamie Foxx, and Kathy Bates as well as seemingly half of That ’70s Show‘s players — is a cut above TV tween starlets’ coming-out slasher slumber parties. It partly succeeds: bringing Valentine’s haters into the game as well as lovers is a smart ploy (although who believes that the chic-cheekbones-and-fulsome-lips crew of Jessica Biel and Jennifer Garner would be dateless on V-Day?), and the first half is obviously structured around the punchlines that punctuate each scene — a winning if contrived device. Juggling multiple storylines with such a whopping cast lends an It’s a Mad Mad Mad Mad World (1963) quality to the Jessica- and Taylor-heavy shenanigans. And some tales get a wee bit more weight than others (the charisma-laden scenes with Bradley Cooper and Roberts cry out for added screentime), creating a strangely lopsided effect that adds unwanted tedium to an affair that should be as here-today-gone-tomorrow as a Whitman’s Sampler. *The White Ribbon In Michael Haneke’s The White Ribbon, his first German-language film in ten years, violence descends on a small northern German village mired in an atmosphere of feudalism and protestant repression. When, over the course of a year, a spate of unaccountable tragedies strikes almost every prominent figure as well as a powerless family of tenant farmers, the village becomes a crucible for aspersion and unease. Meanwhile, a gang of preternaturally calm village children, led by the eerily intense daughter of the authoritarian pastor, keep appearing coincidentally near the sites of the mysterious crimes, lending this Teutonic morality play an unsettling Children of the Corn undertone. Only the schoolteacher, perhaps by virtue of his outsider status, seems capable of discerning the truth, but his low rank on the social pecking order prevent his suspicions from being made public. A protracted examination on the nature of evil — and the troubling moral absolutism from which it stems. (2:24) Opera Plaza. (Nicole Gluckstern)

The Wolfman Remember 2000’s Hollow Man, an update of 1933’s The Invisible Man so over-the-top that it could only have been brought to you by a post-Starship Troopers (1997) Paul Verhoeven? Fear not, Lon Chaney, Jr. fanclub members — The Wolfman sticks fairly true to its 1941 predecessor, setting its tale of a reluctant lycanthrope in Victorian England, where there are plenty of gypsies, foggy moors, silver bullets, angry villagers, and the like. Benicia Del Toro plays Lawrence Talbot, who’s given an American childhood backstory to explain his out-of-place stateside accent (and a Mediterranean-looking mother to make up for the fact that he’s supposed to be the son of Anthony Hopkins). Soon after returning to his estranged father’s crumbling manor, Lawrence is chomped by a you-know-what. Next full moon, Lawrence realizes what he’s become; murderous rampages and much angst ensue. (He’s kind of like the Incredible Hulk, except much hairier). Director Joe Johnston (a tech whiz who worked on the original Star Wars movies, and helmed 2001’s Jurassic Park III), doesn’t offer much innovation on the werewolf legend (or any scares, for that matter). But the effects, including transformation scenes and claw-tastic gore, are predictably top-notch. (2:05) 1000 Van Ness, SF Center. (Eddy)

The Yellow Handkerchief The Yellow Handkerchief is one of those quiet, character-driven dramas that get mistaken for subtle classics. It’s not bad, just bland. In fact, there’s something pleasant about the way the film’s three unlikely friends forge a lasting bond, but the movie as a whole is never quite that cohesive. William Hurt stars as Brett Hanson, an ex-con with a dark past. (The Yellow Handkerchief tries to make this mysterious by way of vague flashbacks, but the audience gets there faster than the film does.) His inadvertent sidekicks are the troubled Martine (Kristen Stewart) and the awkward Gordy (Eddie Redmayne). The talented cast, rounded out by Maria Bello as the wife Brett left behind, does solid work with the material, but no one really stands out enough to elevate The Yellow Handkerchief to greatness. Redmayne is perhaps the most impressive, ditching his British accent to play a character so quirky, he’s almost Rain Man. But after taking a step back, the big picture is muddled. People are fascinating, but what does it all mean? (1:36) Shattuck, Sundance Kabuki. (Peitzman)

Guardian, ACLU, Asian Law Caucus seeks FBI surveillance records

The Guardian is joining the Northern California ACLU and the Asian Law Caucus in seeking records of the FBI’s investigation of Muslim communities.


We’re asking the federal government to turn over documents related to the FBI’s use of informants and infiltrators (reportedly used in gyms, community centers and mosques, investigations of Muslim leaders and imams in Northern California and attempts to recruit Muslim and Arab American children.


From a press release announcing our FOIA request:


According to civil rights organizations, community members, and media reports, the FBI has engaged in a deliberate plan to infiltrate Muslim communities through the use of informants and covert actions. Tensions are especially high between the FBI and Muslim groups following the death of Imam Luqman Ameen Abdullah, a Detroit cleric who was killed under questionable circumstances during an FBI raid in October 2009. 
“When there are repeated and widespread reports that the FBI is building a dragnet that is detrimental to the lives of innocent Americans, the ACLU and other civil rights organizations must step in,” said Julia Harumi Mass, staff attorney of the ACLU-NC. “The first step is to see all the records regarding the planning and implementation of any such spying and surveillance programs, including those that target children and have a potential chilling effect on free speech and religious practices.”


We’re asking for expedited processing so the public can see how taxpayer dollars are used on surveillance and other covert activities.


The response we get will be a good test of how seriously the Justice Department takes President Obama’s order to make government documents accessible unless there’s a very good reason not to.

Guardian reporter’s inside story on arrested protesters

I thought I was keeping a safe distance, observing Day of Action protesters as they went onto Interstate 880 to block traffic rather than participating, until a line of riot cops came barreling towards where I stood by the side of a freeway offramp. But my flight instinct took over, and I found myself running along northbound 880 with my notebook and pen still in my hands. What had been an impressive but otherwise peaceful protest was taking a surreal turn. But maybe I should start from the beginning.

As a recent UC Berkeley grad, I had been on campus many times in the last few months, invited by friends to support the occupations and protests that were fueling an extraordinary movement to defend public education. So I was excited to go out on March 4th to cover the Day of Action in the East Bay. This was a new experience for me. Like any good Berkeley grad, I’ve participated in my share of protests, but now I was a Bay Guardian news intern and this was the first time I was going out as a reporter.

There was a lot to be impressed with that day. In Berkeley, activists had succeeded in creating a broad coalition made up of graduate and undergraduate students, faculty, union members, lecturers, and campus workers and staff. These constituencies were well-represented Thursday morning.

Berkeley organizers were also working to expand their movement beyond the university. Callie Maidhof, a graduate student in anthropology, told me that March 4th is the “first attempt to organize beyond a single system, to organize across California, across the public education systems, and across the nation.”

On the four and a half mile march from Berkeley to downtown Oakland, there was plenty of evidence that they were succeeding. As the Berkeley contingent marched down Telegraph Ave., it was joined by middle school and high school students who brought their own concerns about teacher layoffs and program cuts.

At the rally in Oakland, I spoke to high school students who had walked out of their schools to participate. Sophomore Sienee Dakina from Oakland’s Envision Academy told me that her school lost three teachers because of budget cuts. “We feel like it’s not right,” Dakina said. “We’re losing our teachers.” Ninth graders Victoria Romero and Andrea Barba from Life Academy told me that they were protesting so that the school district would “not take our dreams away.”

When the rally ended, some people were headed to San Francisco to take part in the big rally at Civic Center. I knew that there would already be Guardian reporters there, so I decided to stay in Oakland for what was being billed as an after-protest dance party and “snake march.”

The dance party started around 4:30 with a couple hundred people taking Broadway accompanied by a mobile sound system, black flags, and large banners that declared “We Have Decided Not to Die” and “Occupy Everything.” For the first time that day, I saw riot cops in full force. I read these as signs that something dramatic was probably in store. The dance party wound its way through downtown Oakland, stopping in front of the UC Office of the President before heading towards West Oakland.

I was at the back of the march, talking to an Oakland teacher who was telling me about layoffs at his school, when the police started warning the crowd that they could face arrest. I fell behind and was playing catch-up as a group of around 150 people took to the freeway. I decided to stick by the offramp and watched as a bicyclist, who appeared to be riding on the freeway away from the march, got violently tackled by a fast-moving line of cops.

It was at this point that another line of cops started up the offramp and I fled up the freeway. An officer on a motorcycle yelled at me to continue and join the protesters or face arrest. I ran to catch up with the crowd, which was in chaos as the police approached. (I later learned that, in the chaos, a local high school student fell off the elevated highway and was taken to Highland Hospital with serious injuries.) I saw two kids – perhaps as young as 12 or 13 – trying to get away on skateboards. I was with a cluster of journalists as a line of cops and a blur of batons fell upon a group on the far side of the southbound lanes. We retreated to the dividing wall, me still clutching my pen and notebook, holding my hands in the air.

We were ordered to lay on the ground. My pen was still out so I continued taking notes. An officer noticed me and ordered me up. I explained that I was a reporter and offered to show him proof of my affiliation with the Guardian. “But you’re on a freeway,” he said. “You’re under arrest.” He did help me secure my notes and camera.

I was handcuffed and ordered to kneel on the side of the highway with the protesters, next to a friend from Berkeley, a graduate student at the journalism school. We knelt for hours waiting for the buses that would take us to Glenn Dyer jail in Oakland and Santa Rita jail in Dublin. A handful of stranded motorists cheered, presumably for the protesters, and in one of the lofts next to the freeway, a resident had posted a sign that said “FUCK U Protesters.”

I was sent to Santa Rita with around 100 of those arrested on the freeway. We were informed that we would be charged with misdemeanors and released, but it was clear that our numbers had overwhelmed the jail’s systems. Deputies told us that we would be in there for 10 hours. Ten hours turned into 20, most of that time spent in a cold concrete cell, seven feet long and seven feet wide, with 14 other inmates. There wasn’t room for all of us to lie down at the same time. The fluorescent lights were kept on all night, and I was disoriented, groggy.

The sheriff’s deputies joked about IEDs and half-heartedly threatened us with prison clichés. An agent with U.S. Immigration and Customs Enforcement visited my cell and questioned me and another person of color, asking us for our names and where we were born. My cell mates, worried about the possibility that an undocumented student had been arrested, discussed whether we should refuse to answer their questions. An inmate in a nearby cell hurled obscenities at the “protesters.” But most of the other inmates were merely curious. A few held up their fists in solidarity as they were led past our cell.

I shared cells with a diverse group of people, some I had known for years: a teacher’s aid, a Berkeley freshman computer science major, a veteran, an older man who called himself a communist, and a handful of community college students from Modesto. There were a number of other journalists: two stringers working for Democracy Now!, a reporter from the Daily Californian, and a friend who was covering the protest for Indybay.org. I had seen other journalists with big video rigs on the freeway, but one of the other arrestees told me that they had been allowed to leave.

We passed the time as best we could. The Berkeley computer science major taught us how to fold origami cranes. One of the other reporters gave an impromptu teach-in about some Bay Area residents imprisoned in Iran. We took advantage of the concrete cell’s unique acoustic properties by humming harmonies. A few cells over, the women agitated for food and we got bologna sandwiches and a strange powdered juice that tasted like the color yellow. Mostly, we tried to sleep, in fetal positions, sitting up, or curled around the toilet using our arms, shoes, and rolls of TP for pillows.

There were also discussions about the movement: how to make it broader, how best to organize and make decisions, and what should come next. It was clear to me that many of the people I was with did not know that they would end up on a freeway, but if there were any regrets, no one in my cell let that on. One man commented that the movement was getting bigger – earlier protests had resulted in dozens of arrests, but this one had 150 people taking a freeway. Another said that only the movement “intellectuals” were taking militant action. A community college student objected to that point. Earlier, he had joked about the $6 increase in his fees, but now he spoke bitterly and passionately about how he considered himself working class and not an intellectual. The budget cuts had made him feel that a quality education at a UC was getting further from his grasp.

I was not released until around 4 p.m. on Friday, charged with two misdemeanors – unlawful assembly and obstructing a public place – and ordered to appear in court April 5. Outside the jail, a small crowd of supporters had been gathered all day and it did not take long to find a familiar face and a ride back home.

A friend who had worked through the night to rally support and secure attorneys told me that a lot of students were upset about what had happened. They were critical about what they called a lack of planning and angry that protesters had been led into an action they did not fully understand and did not fully prepare for.

But the freeway action also showed how far the movement has come. Resistance to the budget cuts has spilled out of the universities and gotten bigger, broader, and, yes, perhaps more foolhardy. From my vantage point on that elevated highway, the movement has definitely upped the ante and more and more people are calling the bet.

San Francisco State University added pageantry to the Day of Action protest, one of the many schools from around the Bay Area from Kindergarten to Ph.D that united on the steps of San Francisco City Hall yesterday.

Students, faculty and staff painted their faces, wore colorful t-shirts and paraded 10-feet high puppets depicting a skull-faced grad, a crying queen and a fossilized dinosaur; each representing greedy politics and the killing of education.

SF State students started the day with blocking traffic on Holloway and 19th streets, an echo of the 1968 student strike when SF State students did the same thing to protest civil rights. Police were ordered to clear the protesters out of the streets, but students continued on the sidewalk before merging with several other organized demonstrations in Malcolm X plaza.

Hundreds of students filled the open-air plaza to dance to music, hear spoken word poetry and chant. By 3:30 p.m. the festivities moved to City Hall where university students marched along side elementary, middle and high school students. “We’re in solidarity with everyone in this protest. Not centralized but many coming together to send one message. We have elementary students protesting, for the first time ever all facets of education are joining up. It’s beautiful and it’s healthy,” Phil Lassky, an Ethnic Studies teacher.

Empowerment was the feeling in the air. Many who participated had stories about how budget cuts have kept them from graduating, sitting on the floor in classrooms and not receiving their financial aid checks. “They have forgotten about us. Here we are paying for the bank’s debt and we get our budgets cut? Time for this to stop,” said Andrea Thomas a senior at SF State. Some teachers were uncertain if they’ll have work in the fall, and some were certain they would have no classes to teach.

Not all on the Gator campus were eager to spray paint a sign. Some students said they thought the Day of Action was futile and contradictory. “Ditching class is a hypocritical message that goes against what we are all trying to do,” said Travis Northup, SF State sophomore. “Instead of posters with vague statements we should be trying to find solutions that are reasonable.”

But most of the campus community seemed down with the cause. Ramon Castellblanch, health professor and California Faculty Association president for the university, was one of the leading protest organizers for SF State. Planning had begun back in January and he was astounded by the number of students willing to volunteer. Speaking on those who have chosen not to join in, Castellblanch remarked, “They need to decide the best way to spend their time, usually it’s being in the classroom, other times it’s not. If something doesn’t happen, there may not be any classes left to be in.”

Back in the early ’90s, when MTV played video after video and I was still a kid, I remember seeing tall, hot chicks like Sarah Assbring, the sole member of El Perro Del Mar, flash across the screen, dancing to Axl Rose and Aerosmith. Taking the stage, Assbring immediately struck me as a rock video model, her bright blonde hair chopped off with a stiff asymmetrical edge, lips dark with black-red lipstick, and lids full of smoky shadow. I was immediately envious of her black silky jumper, stitched with an oversupply of fabric under the sleeves that made for the perfect raven wings whenever she lifted her arms.

The sounds of El Perro Del Mar are always sweet and shy, much like the musician herself. She said very little and smiled even less, and yet had me wrapped around her every breath. When she sang, her eyes focused intently on an unknown object in the back of the room, with her eyebrows at a constant downward angle. Often she would raise her hands into the air or send them straight out in front of the mic, nearly reaching the fans in front. She was intense.

Highlights were “A Change of Heart,” which was as delightful live as it is on Love is Not Pop, and “Gotta Get Smart.” After singing the lyrics to the breakup anthem,, Assbring posed a question to the crowd: “Have you ever had your heart broken?”

“Two times,” a man in the front row answered.
“Will you ever be able to love again?” she asked him directly.
“I already have…thanks to you.”

The crowd giggled and awed; Assbring blushed and started “A Better Love” almost immediately. Near the end of the set she covered The XX’s “Shelter,” giving the song a smoky, jazzy twist that continued to build and build until its rushing end. When the set finished, the crowd cheered and yelped, hoping that the double-headliner show would still allow for an encore. Assbring and the band returned,  thanking the crowd for requesting their return with an ABBA-esque number, setting the perfect mood for Taken By Trees.

A multitude of drums and mallets filled the space with African beats, inviting Victoria Bergsman, the solo singer who takes on the name Taken By Trees onto the dark stage. After the first song finished and the crowd cheered, Bergsman’s wild eyes searched the room. A naughty smirk swept across her lips.

“I heard a wolf in the crowd and now I know where you are.”

In terms of energy, Bergsman’s songs were a stark contrast to El Perro Del Mar. Reminding of Lion King, with feel-good micro melodies galloping left and right, I wanted to dance and leap.

Bergsman dedicated a song to a dear friend, encouraged the crowd to clap, and consistently closed her eyes while she sang, often folding her hands in front of her. She was still and mischievous, always looking like she was planning her next cat attack.

Telling the crowd of her tour of San Francisco earlier that day, she explained that she was falling in love with the area.

“I’m thinking about moving here. Should I move here?” she playfully asked the crowd. Without a delay, the place burst into a mess of encouragement.

Their latest album, Sainthood, is a stellar collection of matured, electronically hinged tracks that never fail to get stuck in your head. EDITORIAL Are cars more important than people? Is it OK to evict a tenant just to make space for a garage? Should new garages be designed to preserve on-street parking too? Seems like a no-brainer to us. But legislation by Sup. David Chiu that would put some limits on the expansion of garages — an increasing problem in Chinatown and North Beach — has infuriated some real estate interests, and it’s possible that this eminently reasonable bill might fail.

It’s a sad statement on San Francisco politics, and the implications go way beyond this one planning measure.

The problem has its roots in the Ellis Act, the state law that allows landlords to clear all the tenants out of a building, then sell it to wealthier people who want to buy their units as tenants in common (TICs). The Ellis Act has been responsible for thousands of San Franciscans losing their homes — and a new twist has been developing in Chiu’s district.

In the crowded Chinatown-North Beach area, parking is at a premium and people who are buying TICs want a place to put their cars. So landlords and speculators are throwing out tenants not just for new owners, but to make room for garages.

Chiu’s law — which would apply only in parts of District 3 — would deny building owners a permit to construct a new garage if a tenant was evicted under the Ellis Act in the past 10 years. And it would require a conditional use authorization from the City Planning Department for any new garage construction.

Chiu also wants new rules for curb cuts — the openings in sidewalks that allow cars to drive into garages. The cuts would have to be as small as possible and designed to preserve on-street parking.

On a larger level, the bill would make it easier to construct new housing without parking — a significant change in how San Francisco has handled off-street parking for many years. Instead of mandating garages in new apartment buildings, Chiu wants to discourage them. He’s saying, in essence, that space for people is more important than space for cars.

That’s a logical step in a city that is trying to enforce a transit-first policy. It’s a small piece of a larger political battle to transform a city planning system that for too long has been driven by the needs of the private automobile. It should have passed unanimously and Mayor Newsom should sign it into law.

In fact, the bill passed on first reading Feb. 9, with only Sups. Sean Elsbernd and Carmen Chu voting against it. But Sup. Bevan Dufty now says he has concerns about the measure, and Chiu has agreed to postpone the final vote until March 9.

Dufty’s a key vote, because it’s likely at this point that the mayor will veto the measure. And with Elsbernd and Chu opposed and Michela Alioto-Pier still out with health problems, supporters can’t override a veto without Dufty.

We couldn’t reach Dufty, but supporters of the bill say he wants the measure watered down to eliminate the conditional use requirement — which would force city planners to check and make sure the builder or landlord was following the rules — and replace it with a discretionary review requirement, which would allow the garage construction unless someone objected. That puts the burden on the tenants (who in many cases are low income people whose primary language isn’t English) to protect themselves. And it would undermine much of the power of the bill.

It’s insane for Dufty to oppose a reasonable measure that only applies to a small part of one district, protects vulnerable tenants, and pushes the city away from further automobile dependence. It’s insane that the mayor is expected to veto the bill. It’s insane that it’s even an issue. And if the ordinance fails, it will be a sign that even in San Francisco, in 2010, landlords, developers, and cars are still king.

My son, my son, what have ye done

FILM Some of the best documentaries in recent years have been hijacked by their subject — or even by another subject the filmmaker wasn’t planning on. Prodigal Sons was supposed to be Kimberly Reed’s story about a high-school quarterback, basketball captain, class president, and valedictorian born to a family of Montana farmers, returning for a reunion 20 years later — albeit as a fully transitioned male-to-female transgender person attending with her female lover. This will definitely be news to most of Helena, Mont., especially those former classmates who once swooned with puppy love or envy over the jock prince who is no more.

That would have made for an interesting movie. What makes Sons a fascinating one is that Reed finds the camera focus — as director/producer/coeditor, her own camera — stolen almost right away by a crisis in progress. Its name is Marc, adopted “problem child” of the McKerrow family (Kimberly changed her surname post-op). It’s not so much that Marc grabs the spotlight out of a jealous need for attention, though that may be a factor. It’s that he’s still trapped in a sibling relationship that for her ceased to exist — at least in its original form — decades ago, and Kimberly’s presence stirs up all kinds of buried shit.

Marc’s living in the past isn’t mere self-pity or indulgence. Already stamped as a bit of a fuckup (held back in grade school, a high school dropout), he suffered a head injury at 21. That commenced an ordeal of seizures, brain surgeries, and complicated med cocktails. He’s married with a daughter, but emits toxic clouds of social awkwardness and discontent that sometimes erupt in violent mood swings, which here result in at least one police intervention.

“It’s not the real me” is his usual refrain afterward each such “episode.” While Kimberly looks to reconcile her successful new identity with a community she’d ago severed most ties to, Marc struggles to assert any cogent post-accident identity at all.

Running a gamut from harrowing to miraculous (not necessarily in that order), the remarkable Prodigal Sons grows stranger than fiction when abandoned-at-birth Marc discovers something jaw-dropping about his ancestry. Suffice it to say, this results in a trip to Croatia and biological link to some of Hollywood’s starriest legends.

If Kimberly’s story is about repression forcing a mentally healthy transformation, Marc wrests us away from that inspirational self-portrait. He renders Sons a challenging, head-on glimpse of mental illness with no easy answers in sight. Christianity, a well-adjusted gay third brother, conservative yet surprisingly adaptable parents, jail time, savant piano mastery, and other elements also factor into this wild ride of a documentary. Its narrative progress might be dismissed as over-the-top if it didn’t happen to be true.

Expanding movement

When University of California Berkeley students staged building occupations last fall, their furious, brazen response to startling tuition hikes and staff cutbacks captured the attention of the world, recalling the radical actions of earlier generations.

Yet the thrust behind the March 4 Strike and Day of Action, a mass mobilization for public education and services that is reaching into all corners of the state and spreading nationwide, appears to stem from widespread agitation that extends well beyond the flare-ups on college campuses.

"What’s historic about this is that pre-K through PhD has never walked together," said Lillian Taiz, president of the California Faculty Association, which represents faculty in the California State University system. "We have often been pitted against one another, and I think everyone feels finally, in the end, there is no difference in importance between pre-K and PhD. We need it all."

The historic new alliance faces an uphill climb in an environment characterized by a devastating budget crisis at the state level. California — the world’s eighth-largest economy — hovers around 47th in the nation in terms of per-pupil spending, and the most recent wave of budget rollbacks has cut to the bone.

Students and teachers across the Bay Area argue that with dramatic slashes in funding, the educational system is failing youth. Class sizes are ballooning to claustrophobic levels, students are unable to take their desired courses, fees are going up, bathrooms are getting cleaned less frequently, and staffers are getting stressed by overwhelming workloads. "Classes are jam-packed," Taiz says. "You have kids sitting on the floor. You have students just begging to be allowed in a class."

As University of California students decry a 32 percent hike in fees, the California State University system is suffering from damage inflicted by 2,000 faculty layoffs over the past year. The San Francisco Unified School District, meanwhile, is staring down an estimated $113 million budget deficit over the next two years, and 900 layoff notices recently were issued to teachers, librarians, secretaries, and other school employees to warn them that their jobs could be slashed by the end of the school year.

When San Francisco’s school district faced a gaping budget shortfall during the last budget cycle, it was propped up by a combination of Rainy Day Fund reserve dollars and stimulus funding from the American Recovery and Reinvestment Act. With no such safety nets in place this time around, anxiety levels are higher and the outlook is uncertain.

March 4 is shaping up to be more than an opportunity to vent frustrations to elected leaders. Instead, organizers describe it as a rallying point for a movement to defend public education that has caught on like wildfire, uniting people from different worlds. Pickets and rallies will be staged throughout the region. Thousands are expected to swarm Civic Center Plaza in San Francisco. Students from a handful of East Bay campuses are organizing marches to Frank Ogawa Plaza in downtown Oakland. Students and faculty from Berkeley will be boarding buses to take the message to Sacramento. The Oakland Unified School district will host a districtwide mock "disaster drill" to call attention to the disastrous budget. Even public transit activists opposed to the latest round of Muni service cuts and fare hikes are joining the protests, hoping to expand the discussion to support vital public services (for details on these and other events, see "Alerts" opposite this page).

"We’ve never gotten this level of activism over anything in SF since I’ve been here," says Matthew Hardy, communications director for United Educators of San Francisco. "There’s a growing movement for progressive taxation and budget reform instead of draconian cuts."

Taiz, who teaches history at Cal State Los Angeles, described March 4 as an opportunity to fill a void in leadership. "Historically, in these moments where ordinary people step up to the plate, you end up leading the leaders," she said. "We are kind of shocked, but in truth, we do know what has to be done." Quality education isn’t just important for young people, but for society as a whole, she argued. "I am a baby boomer, and if the folks coming up behind me don’t have really, really good jobs, I’m going to be eating dog food. Because those are the people who pay Social Security and pay the taxes."

In the week preceding March 4, teachers and students throughout the Bay Area were in a frenzy of preparation.

Carlos Baron, a theater professor at SF State, was wondering whether the grand procession of papier-mâché puppets his theater students will unveil on the March 4 Day of Action should take a V-shape or some other form. "The main puppet is the Draculator," explained Baron, a Chilean who directed plays in the Salvador Allende era before he began teaching at SF State in 1978. "It’s a cross between the Terminator-Governor and Dracula. But also it doubles as a banker and a general."

When asked how funding cutbacks affect students, Baron didn’t hesitate. "It impedes the creation of a positive vision for themselves and this society," he said. It stunts "the development of the imagination," he added. "We are trained as individuals to accept our failure and our smallness because we’re familiar with it. They don’t want an educated population, a sensitive population, a dreaming population. Would we select Schwarzenegger?"

Nicole Abreu Shepard, a first-grade teacher at Buena Vista Elementary in San Francisco’s Mission District, was collecting permission slips from parents to take her students to a rally and march down 24th Street. "The entire school is walking out," Abreu Shepherd said. Buena Vista’s art program exists solely because parents volunteer their time, she explained. More than half the students qualify for free or reduced lunch, and many incoming kindergarteners or preschoolers are new to the English language. Now there are proposals on the table to increase kindergarten class sizes to 25 or possibly even 30 students. "It’s sort of tying their hands behind their back and asking them to teach on one foot," she noted, and worried about the eventual result. "It’s going to be harder and harder to keep parents who could afford private school in a public school system."

Meanwhile, at the UC Berkeley campus, Krystof Cantor was sitting behind a table heaped with piles of radical literature bearing titles such as "After the Fall: Communiques from an Occupied California." Cantor, who earned his PhD in vision science in 2005, was joining student organizers in making one last push to drum up student interest in March 4 events at a multi-faceted event called "Rolling University." Late on the evening of Feb. 26, a dance party on the Berkeley campus morphed into a street riot — replete with ignited Dumpsters — in downtown Berkeley. The incident attracted media attention and drew public criticism from administrative officials.

The radicalized student movement that has erupted on the UC Berkeley campus is "very much about seizing power," Cantor told the Guardian several days before. "It’s been disruptive, it’s been militant, and it’s been creative. That’s very scary," to the administrators the movement is targeting, he added.

That focused pressure on UC administrators sets these students apart from the coalition of UC Berkeley faculty members and student government members and allies who are coordinating bus trips to protest in Sacramento March 4, he explained. "Sacramento’s not innocent, but it’s not like the administrators are just doing what they have to do," he charged, pointing to new construction projects on campus even as workers are hit with layoffs and furloughs, plus an increasing trend of privatizing on-campus jobs and services. "You can save the public sector by pouring money into it. But it won’t work if the people in charge … want to privatize everything."

Jasper Bernes, a graduate student in English who was seated next to Cantor, noted that the occupation tactic is catching on at other campuses. "I have no doubt that March 4 will greet us with news of many occupations," he said.

Baron, the Chilean theater professor, noted that some SF State students had occupied a business school building in protest of budget cuts. "They were pissed," he said. "They wanted to do something radical. They really inconvenienced a lot of people — but they took chances nonetheless. I went there, and I locked arms with them for awhile." At the same time, he wondered about how effective it was, he said.

And for all the months of preparation and visioning, Baron said he also wonders what will ultimately be borne out of the marches, rallies, pickets, and procession of lovingly crafted street puppets he helped breathe life into. For all the hard work and planning, he says, "My problem is not so much March 4. It’s March 5."

Pressure builds to save Muni

Widespread frustration with Muni service cuts and fare hikes – passionately expressed by the public on Friday at a San Francisco Municipal Transportation Agency meeting that continues tomorrow (Tuesday, March 2, starting at noon in City Hall Room 400) – has prompted a surprisingly diverse backlash.

From angry, street-level progressive activists to the downtown-friendly San Francisco Planning and Urban Research Association (SPUR), San Franciscans are criticizing the SFMTA’s budget plan (including the 10 percent service cuts approved on Friday, which could be revisited tomorrow) as short-sighted and unnecessarily divisive, prompting the biggest and most diffuse progressive organizing effort in years.

“I’ve never seen anything like this,” SFMTA spokesperson Judson True told me as he surveyed the huge, passionate crowd assembled for Friday’s meeting, adding, “It’s clear grassroots organizing is alive and well in San Francisco.”

It’s true that grassroots organizing helped with Friday’s massive turnout, with hundreds of people lined up to give almost five hours worth of public testimony, much of it expressing frustration with poor city leadership (particularly by Mayor Gavin Newsom and his appointed SFMTA board and director) and declining public services.

But these weren’t the talking points of a centrally organized effort, which is what’s so remarkable about this movement. While many progressive groups joined forces under the Transit Not Traffic banner (coordinated by MTA Citizens Advisory Board member Sue Vaughn and others), and there’s a new San Francisco transit riders union (coordinated by transportation activist Dave Synder), the huge turnout on Friday came also from disability rights groups, ethnically identified groups from the Mission and Chinatown, the Senior Action Network, San Francisco Tomorrow, the social justice group POWER, the antiwar ANSWER Coalition, and several other groups, with very little coordination among them.

“We are really seeing a diverse group of people arguing for transit justice,” said Marc Caswell of the San Francisco Bicycle Coalition, which was part of the Transit Not Traffic coalition.

In fact, with Muni fares increasing and services declining since Newsom became mayor, a wide variety of groups seems to have figured out independently that there’s something seriously wrong with Newsom’s no-new-taxes approach to running the city, particularly given declining transit funding from the state and feds.

“These aren’t solutions. They’re just pitting one group against another,” said Frank Lara of the ANSWER Coalition, which opposes a proposal for extended parking meter hours, much to the chagrin of progressive groups who want motorists to help close the budget gap by giving up their free parking on Sundays.

One SPUR proposal also seeks to eliminate this pitting of groups against each other, listing as its biggest dollar proposal the elimination of work orders from the San Francisco Police Department, which would save $12.2 million per year, which the SFPD charges SFMTA for unspecified services that it has yet to document, despite agreeing to as part of last year’s budget deal.

When asked about the work order proposal, Newsom press secretary Tony Winnicker said doing so would make Muni less safe by discouraging officers from riding buses, saying such work orders were a “good accounting practice” rather than the budgetary shell game that progressive supervisors and SPUR director Gabriel Metcalf have called it.

“The gamesmanship with work orders has got to stop,” Metcalf told the Guardian, criticizing the SFMTA for cutting service across the board and raising fares for express bus service and cable cars. “They don’t have to do that and they shouldn’t do that. They just need some political courage right now.”

The next largest SPUR proposals are to charge $300 per year for disabled placards that allow drivers to park for free (which would raise $10 million per year) and to enforce existing city codes that require garages to charge by the hour rather than all day (which would raise $6.85 million), followed by Muni work rule changes that would need union approval.

Winnicker said Newsom was aware of the big turnout on Friday and the anger voiced by the crowd, telling us, “He understands people are concerned and he shares those concerns.” But rather than accepting that many people blame Newsom, Winnicker blamed Muni’s Transportation Workers Union for voting down about $5 million worth of wage concessions and work rule changes. Yet many speakers criticized Newsom’s finger-pointing on Friday, saying he and the SFMTA were too focused on targeting workers rather than the downtown corporations that Newsom has refused to adequately tax.

“There was already a fare increase last year, so for the low-income popular, this is major,” Wing Hoo Leung, vice president of the Community Tenants Association, told me in Mandarin, translated by Tan Chow, an organizer with Chinatown Community Development Center. “In a bad economy, the low-income people can’t get hit again and again. We need to cut from the top.”

Tax measures will be a big part of tomorrow’s SFMTA discussion of the $100 million budget deficit looming for the next two years – such as a parcel tax, downtown transit assessment district, parking tax increase, or local vehicle license fee — and several SFMTA board members agreed with the statement made Friday by Trustee Malcolm Heinicke that, “We need to look for other sources of revenue.”

Even Winnicker said Newsom acknowledges the need to discuss tax measures, even though he philosophically opposes them: “He understands that many things have to be on the table to close next year’s budget gap.”

But he’s far from advocating for any revenue-side solutions.

“The mayor doesn’t think the tax measures will have much public support,” Winnicker said. Yet progressive groups say that’s because Newsom has undermined people’s faith in local government and actively opposed tax increases rather than trying to make the case to the public that they’re needed to present public transit and other vital services.

“Newsom has to be out there fighting, one at the state level, and he needs to show some leadership here,” said Bob Allen of the group Urban Habitat. “I don’t want to hear Gavin Newsom say again that this is a transit-first city if he’s not going to do anything to support it.”

But Allen said that if Newsom and other city leaders made the case for new taxes to support transit and ran a strong campaign, “This city will support a ballot measure to protect Muni and expand it.”

Yet right now, he said one of the things frustrating low-income San Franciscans is there is a basic inequity between motorists and Muni riders: “If parking is going to be free on Sunday, transit should be free on Sunday. If parking is going to be free in the evenings, transit should be free in the evenings.”  

Newsom has long voiced opposition to extended meter hours, only recently softening that position slightly to possibly allow for a small pilot program for Sundays. But his appointed trustees might be willing to go even further, with Bruce Oka saying on Friday, “I know the mayor doesn’t like it, but it has to be tried.”

The Chronicle’s dishonest hit on district elections

The move to get rid of district elections – which is based entirely on the fact that big business and more conservative voices (including the Chron) don’t like the progressive policy positions of the current board – is now well under way. The Chron devoted its Insight section to the issue Feb. 28, leading with a long editorial that wandered back and forth between points and never really made the case.


An example of the Chron’s logic:


But sitting atop the decision-making tree [in San Francisco] are small-time politicos, some elected with fewer than 10,000 votes in a city with a population of 808,976.


Horrifying! It’s as if the United States Congress – which has to decide issues like war and peace — was made up of local politicos who were elected with as few as 100,000 votes in a nation of 350 million.


Or as if the California Assembly – which has to deal with a $28 billion budget deficit – was made up of local politicos who were elected with as few as 50,000 votes in a state of more than 35 million.


A district supes votes could represent about 1.2 percent of the entire city. A state Assembly member could represent only 0.1 percent of the population of the state. And yet, I don’t hear the Chron calling for the state Assembly to be replaced with an at-large body.

A town with sweeping plans to develop two empty Navy bases at Hunters Point and Treasure Island, fill vacant offices with new jobs, and cut its budget by more than a half billion dollars isn’t getting the thought, expertise – and citywide vision – it needs for these challenges.
This lack of broad leadership obstructs the city’s future. A major cause is the district election system that magnifies neighborhood and tight-knit interest groups to produce officeholders with little stake in citywide questions. If all politics is local, as former House Speaker Tip O’Neill famously declared, then San Francisco has pushed this dictum to the max. It’s all about me and my neighborhood.


That’s absolutely, factually untrue – the district elected board has done more to advance citywide issues – from minimum wage to health care to the rainy day fund to infrastructure planning – than any at-large board in the previous 20 years.


And the Chron’s own editorial contradicts that argument:


Supervisor David Campos (a winner with 9,440 votes) led a move to keep illegal immigrants who are juveniles accused of felonies from being turned over to federal authorities, despite a city legal opinion that the idea wouldn’t fly. Supervisor John Avalos (6,918 votes) dreamed up the “must spend” order directing the mayor to maintain expenditures in a record deficit year. Thankfully, he dropped the idea at the 11th hour


Okay, I get that the Chronicle editorial board doesn’t like the Campos sanctuary bill or the Avalos must-spend legislation – but that are both citywide issues. They have nothing to do with “me and my neighborhood.”


Which is really the entire point here. The Chron doesn’t like the outcome of district elections – because over the past ten years, the progressives have shown they can win district races. There’s a good reason for that; in district races, you don’t need to raise huge amounts of money.


As Assemblymember Tom Ammiano and Supervisor David Chiu point out in an opposing editorial:


Part of that increased accessibility to government is the result of the decrease in the cost of running a district versus a citywide election. In the 1994 citywide elections, the average winning candidate spent $456,000 in today’s dollars. That’s 225 percent greater than the amount spent today: In 2008, the winning candidates spent an average of $204,000. Candidates needing to raise money for a citywide race will inevitably turn to special interests for contributions. If you believe elected representatives should speak up for people, not just the special interests that donated to their campaigns, today’s district system serves you better.



They also note:


Before district elections were passed, under a citywide election system, many neighborhoods – the Excelsior, the Sunset, the Mission and Bayview-Hunters Point – had no supervisor of their own. Today, all residents can pick up the phone and reach an office responsible for their neighborhood and responsive to their concerns – a broken streetlight, a dangerous pothole or a consistently tardy Muni line.


A lot of people don’t like Chris Daly’s personality, and some don’t like his politics, but if you’re a person living on SSI in a grubby little hotel room in the Tenderloin and you need help, you can walk into his office and get a welcome reception and assistance with your needs. You won’t get that from the mayor.


On the other hand, do you think, Don Fisher ever needed to stand in line and try to make a 15-minute appointment to talk to Gavin Newsom? Seriously?


And while we’re on the personality stuff: Yeah, some of Daly’s antics have been over the top. But he’s no worse than some of the others who have served on citywide boards. Former Sup. Bill Maher once accused one of his opponents of having a small penis, and waved around two fingers spread about an inch apart to the press and public.


More important, we had supervisors who did nothing. We had supervisors who did exactly what the mayor said without any question. We had supervisors who were wholly-owned subsidiaries of major local corporations. I’ll take Chris Daly over those folks any day.


By any rational standard, the district board over the past ten years has been more productive, more accountable, more representative and more accessible than any at-large board I’ve seen in my almost 30 years of covering this city.


So the Chron needs to shut up about “citywide perspective”’ and personalities. If the paper wants to oppose district elections, it needs to drop the poll-tested downtown talking points and tell the truth:


The current board is too liberal for the Chron. The moderate candidates the paper prefers can’t win in districts. So they want to change the rules.


That’s the story, beginning, middle and end.


 

Muni cuts spark popular backlash

Tomorrow’s big showdown over the latest round of Muni service cuts and fare hikes seems to be galvanizing transit supporters and giving birth to a rejuvenated progressive advocacy effort, including a new transit riders union led by noted alternative transportation advocate Dave Snyder. And that hearing is just a prelude to a taxi medallion privatization plan that will be heard in the afternoon and another big Muni budget blowout on Tuesday.

“We are asking everyone to show up and complain about the mayor and the MTA board’s failure to prepare for this and find alternatives to the drastic cuts they’re proposing,” Snyder told us, referring to the San Francisco Municipal Transportation Agency’s plans to close a $16.9 million mid-year budget deficit (which is what’s left after the $11 million from the taxi permit selloff, which the MTA has already figured into the budget) almost entirely on the backs of Muni riders, who have already seen their fares double since Gavin Newsom became mayor in 2004.

The hearing is Friday at 9 a.m. in City Hall Room 400. That afternoon, Snyder will meet with a broad-based advisory board that he’s assembled to lead (and to name) the new transit riders union that he’s been working on for months, and his tentative plan is to formally launch it on Monday.

For now, those interested in being part of this fledgling organization can sign up here. The new organization is being launched as the MTA board moves from tomorrow’s controversial meeting into another one on Tuesday, that one to start grappling with the huge budget deficit the agency will still face in the next fiscal year that begins in June, even if it’s successful in closing this year’s.  

Snyder is probably just the right person to lead this effort, having directed the San Francisco Bicycle Coalition in its formative years before founding Transportation for a Livable City (now known as Livable City) and then becoming the transportation policy director for the San Francisco Planning and Urban Research Association (SPUR), a post he left last year during a controversy surrounding Snyder’s appointment to the Golden Gate Bridge, Highway, and Transportation District Board of Directors. 

Snyder said Newsom and the MTA board have failed to plan for this foreseeable funding shortfall, saying they should have accelerated plans for extended parking meter hours (particularly ending the free parking on Sundays), a congestion pricing program, a local vehicle license fee, or measures like a gas tax, transit assessment fee, or a parcel tax – all of which the MTA board and mayor could have placed on the ballot for voter approval. Instead, they did nothing and are now pursuing a 10 percent reduction in Muni service, which could start a disastrous downward spiral.

“They need a stable, long-term funding source,” Snyder told us. “The charter actually says they’re supposed to aggressively seek new sources of funding.”

MTA spokesperson Judson True said that neither tax increases nor extended parking meter hours among the proposed solutions for Friday’s discussion, but they’re likely to be raised as part of a longer term strategy during the meeting on Tuesday: “It’s likely that the various tax measures will be part of that discussion.”

That could include reviving the extended parking meter hours proposal, which the MTA board heard last year during a rancorous public meeting, directing staff to do more community outreach on it. As True said, “We did a fair amount of outreach on it so we’ll see where the discussion goes on the two-year budget.”

Snyder is hardly alone in his local advocacy for budget solutions that spare Muni from deep cuts. In fact, the Transit Not Traffic coalition that successfully pushed the 2007 MTA reform measure Prop. A – which includes the Bike Coalition, Livable City, Walk SF, and other progressive groups – has revived itself in advance of tomorrow’s meeting and will be flying outside City Hall starting at 8:30 a.m.

There is broad support on the left for seeking more funding from drivers and the general public, but it’s not unanimous. The anti-war ANSWER Coalition frustrated many of its usual progressive allies last year by organizing against extended meter hours, claiming it was a hidden tax of low-income motorists. And Newsom has stubbornly resisted supporting new revenue measures, even in the face of unprecedented budget shortfalls, which makes the quest to win the support of two-thirds of voters difficult.

But the popular outrage that’s been expressed in recent weeks about how much Muni has been cut, year after year since Newsom became mayor, will likely put pressure on him and the MTA board (all of whom Newsom appointed) to pursue new revenue options.

True sounded weary as we spoke, noting how much anger has been expressed at the recent series of town hall meetings. “We know where people stand on these proposals,” True said. “The board is going to have some tough decisions to make, clearly.”

The battle for the forgotten district

This November, when voters in District 10 — the largest, sunniest, and most diverse of the city’s 11 supervisorial districts — replace termed out Sup. Sophie Maxwell, they’ll be making a selection that could have pivotal implications for the entire city.

That’s because the next supervisor from southeast San Francisco inherits a district that is home to some of the city’s biggest environmental and public health challenges, as well as the most potential for development that will determine what kind of city San Francisco becomes.

District 10 is where you’ll find the most polluted and most underdeveloped lands in San Francisco, areas that could either be transformed into models of a sustainability or, in the words of Tony Kelly, the president of Potrero Boosters Neighborhood Association, “be turned into a toxic Foster City.”

District 10 is where the slaughterhouses, tanneries, and glue factories set up shop and used the bay as a dumping ground. It’s where the smokestacks of coal and oil fired power plants polluted the air. It’s where the Navy filled the Bay, built a shipyard at Hunters Point and loaded parts of the first atomic bomb onto the USS Indianapolis in 1945.

District 10 is where the bottom fell out of this industrial economy in 1974, when the Navy left, taking with it people’s jobs, pay, and hopes for a home of their own and a better future, particularly for what was then a predominantly African American population.

And District 10 is ground zero for plans that will triple the population and double the number of homes — homes that likely will only be “affordable” to Google executives and retirees from Marin, forever changing the face of San Francisco’s southeast sector. Critics fear that will accelerate what has been a steady exodus of black residents, replaced by megadeveloper Lennar’s vision for a new D10.

It’s against this dark history and difficult present that a wide open field of more than a dozen candidates are vying to replace Maxwell, who came to power in 2000 and has had a mixed voting record in her decade on the board. Sometimes, Maxwell was the eighth vote that let the progressive majority on the Board override Mayor Gavin Newsom’s veto and pass trailblazing legislation. Other times, she was the swing vote that allowed the moderate minority to carry Newsom’s water.

So, in addition to D10’s many internal challenges, this seat could determine the political balance of power on the Board of Supervisors, placing all the more importance on voters in this long-marginalized part of town.

 

DISTRICT OF DISCONTENT

Eric Smith, a biodiesel activist who has thrown his hat in the D10 ring, says that there is a lot of frustration in the air, and looking at the problems the district is facing, it’s hardly surprising that it has what nearly every candidate agrees is a fractured political culture.

“The Bayview, the Hunters Point Shipyard’s toxic Superfund site, the homicide rate, unemployment, poor public transportation, dwindling services and community resources have made D10 one of the city’s largest melting pots of discontent,” Smith said.

Smith’s words were spoken while the Elections Department was verifying signatures earlier this month on a second failed effort to qualify a petition to recall Maxwell.

Bayview resident and D10 candidate Marie Franklin didn’t support the attempt to recall Maxwell, but she understood it as “a frustration movement.”

“People are sinking in the sand, we’ve already lost so many of them, and they felt Sophie wasn’t doing anything for them,” said Franklin, who praised Maxwell for helping get Franklin’s apartment building complex renovated — a job that was completed 18 months ago, at a cost of $65 million, creating 500 local jobs.

“There are 654 units here, and they were uninhabitable,” Franklin said. “There was black mold, rain falling inside. We had people living worse than Haiti.”

Franklin, who said she is running because she “knows the history,” came here in 1978, when she and her son were living in a car after a fire left them homeless. She said the Bayview was a totally isolated area, barely part of mainstream San Francisco.

“There were no taxis, no services,” she recalled. “Nobody would come here, it was the stigmatized area where no one was accountable to provide services.”

The Bayview — which in some ways is the heart of D-!0 — wasn’t always a black community. But African Americans have been living here for 70 years, dealing with all the racism, denial of services, poverty, and pollution. And it bothers Franklin that 85 percent of the 10,500 homes that Lennar plans to develop won’t be affordable to the elderly, disabled, unemployed and low-income people who currently live in the Bayview.

“We need to preserve the diversity of the community and make sure their issues and information will flow to City Hall,” she said. “You must give the people a handle. If you don’t reach out, they’ll slip. That’s why folks out migrated.

Whoever succeeds Maxwell will be a central player in addressing some very big and dirty issues: the future of the Navy’s radiologically impacted shipyard at Hunters Point, Lennar’s massive redevelopment plan for the Shipyard and Candlestick Point, the polluting power plants, replacement of stinky digesters at the sewage plant, and the SF Hope public lousing rebuild.

There’s also the chance to address violence and crime. James Calloway, a candidate who has long worked in Bay Area schools, told us he believes that education and jobs are part of the keys to rejuvenating the district.

“Job opportunities are not as plentiful in the district,” Calloway said. “When I was a kid, you could walk down Third Street at 2 a.m. Now I wouldn’t walk down it at 9 p.m., and I know the area.”

Calloway is hopeful that the massive redevelopment plan, if done correctly, could start the district’s comeback. “Not a lot of black folks stay here when they have extensive education,” he said. “But it’s not only them. Many were displaced by redevelopment and had no way to go back.”

 

ELECTION UP FOR GRABS

The largest of the city’s 11 electoral districts, D10 is a huge triangular piece of land in the city’s southeast sector that was used as an industrial dumping zone for decades. Today, the district runs from the Giants stadium at AT&T Park to the 49ers stadium at Candlestick Point and encompasses Mission Bay, Potrero Hill, Dogpatch, India Basin, Portola, Little Hollywood, and Visitacion Valley. It’s also crossed by two freeways that isolate it from the rest of the city, and is home to a large number of crumbling housing projects that are in the process of being rebuilt.

Candidate Ed Donaldson grew up in the projects until he was 10 years old, when the Redevelopment Agency kicked his family out in the 1970s. “We landed on our feet, but others weren’t so lucky,” said Donaldson, who works as a housing counseling director at the San Francisco Housing Development Corporation.

“There is a sense that the Bayview and Visitacion Valley have not been included within the San Francisco family,” Donaldson said. “There is a sense of being forgotten.”

In 2007, Donaldson co-founded the Osiris Coalition to tackle the city’s dormant Certificate of Preference program, in which the Redevelopment Agency issued a document to displaced residents and businesses in the 1960s promising that they could return.

He also tried to rescue some 700 foreclosed properties and recycle them as affordable housing stock. And now he is trying to prevent the city from bulldozing seven SF Hope projects without guaranteeing residents that they have right to remain.

In 2007, Mayor Gavin Newsom and Maxwell convened an African American Outmigration Task Force that didn’t get a public hearing about its findings until August 2008. The timing angered some, who questioned why the report’s findings and implications for urban planning weren’t released before June 2008, when the residents of San Francisco voted for the Lennar-led Proposition G, a proposal to build 10,000 market rate homes at one of San Francisco’s last remaining black communities, which Newsom and Maxwell endorsed.

The taskforce didn’t publish its recommendations until the end of 2009, allegedly because of insider squabbling. Meanwhile, gentrification was going on actively, and many blamed Newsom, and by extension Maxwell, for failing to do anything with the group’s findings as D10 residents continued to suffer from high rates of asthma, cancer, unemployment and an ongoing black exodus.

It wasn’t always this way. In the 1940s, the district’s black population exploded when migrants from the south and World War II veterans came to work at the Hunters Point Naval Shipyard. Some moved to Alice Griffith Public Housing complex, or Double Rock, which was built as military housing in 1962. Others relocated to the Bayview when the Redevelopment Agency took over the Fillmore/Western Addition in the ’60s and ’70s as part of a controversial urban renewal effort.

But when the Navy abandoned the shipyard in 1974, unemployment hit the black community hard. Today, hundreds of the city’s lowest income residents live in Alice Griffith’s crumbling units and endure sewage backups, no heat, cloudy drinking water and leaking ceilings, as they wait for the projects to be rebuilt.

“Generations have been trapped in the silo of public housing and cannot get out, because of lack of opportunity and education, so when we legislate, we need to take that into consideration,” said candidate Malia Cohen, whose grandfather came from Texas to work at the shipyard where he met her grandmother, whose family came from New Orleans.

“My grandfather’s father was a longshoreman. He worked with the infamous Leroy King [a commissioner at the city’s Redevelopment Agency] and he has fantastically vivid stories of racism,” said Cohen, who works for the Federal Reserve Bank of San Francisco, previously served on the executive staff of Mayor Gavin Newsom, and has already raised over $18,000 in the D10 race and qualified for public matching funds.

“My family came here to work hard, they lived on Navy road in the projects, and then they bought a house here. My parents were born here, and we were all public schooled,” Cohen recalled as she took me on a tour of D10 that ended up in Visitacion Valley, an increasingly Chinese-American neighborhood that reflects a district-wide trend.

Census data show that by 2000, Asians were the largest racial group in the district (30 percent), followed by blacks (29 percent), whites (26 percent), and Latinos (19 percent). By 2003, according to the California Urban Issues project, the trend continued. Asians were the largest racial group (32 percent), followed by blacks (27 percent), whites (21 percent) and Latinos (17 percent) of the population.

This means that D10 candidates will have to garner support from more than one ethnic group to win. Over a dozen candidates have already filed papers in the race, but so far there is no clear front-runner.

Also frustrating the prognosticators is that fact that D10 has had the lowest voter turnout in the city, so the winner will also depend on who goes to the polls.

D10 candidate Geoffrea Morris, who is the grand daughter of longtime Bayview activist Charlie Walker, has been knocking on doors and participating in voter registration drives.

“We need new blood,” Morris said

Getting elected will be a complicated equation. Although Bayview’s population was 50 percent African American at the time of the 2000 census, it didn’t turn out the vote. In the 2006 election, only 14,000 of the district’s 37,000 registered voters went to the ballot, and 50 percent were from whiter, richer, and more Asian neighborhoods.

“It’s very important to the future of the city that the ethnicity diversity of the board be maintained and that the African American community have representation,” former Board President and current Democratic Party chair Aaron Peskin told the Guardian.

Maxwell recently told the Guardian that she’s not ready to endorse any D10 candidates yet. “I’m waiting for people to have a better understanding of what this community is, what the common thread running through it is, and how to use rank choice voting,” she told us.

The only candidate who currently holds elected office is BART director Lynette Sweet, who had her answers down pat when we reached her by phone, and even used wording that was eerily similar to Maxwell’s words.

“D10 is a pretty diverse district, but there is only one common thread: the need for economic development,” Sweet told me. “That’s true in Potrero Hill, Portola, Dog Patch and the Bayview. It’s the same mantra: a lot of small businesses need help, and the only way to help them is through economic development. In Potrero Hill it’s about land use. In the Bayview, it’s about the shipyard and better transportation and truancies.”

 

THE COMMON THREAD

District 10 is ground zero for the Lennar’s $2.2 billion plan to develop 10,500 market rate condos at the Shipyard and Candlestick Point. The plan will allegedly create thousands of jobs and new parks, deliver on an historic community benefits agreement that labor groups claim is so “lawyered up” that the developer can’t renege on its promises.

The package is framed as the one and only way to revitalize the southeast’s formerly vibrant economic engine. Indeed, any time anyone tries to slow down the process—to take time to thoroughly read the draft EIR and see if it adequately addresses the impacts of this massive urban reengineering project — a chorus of “no delays” starts up, either from residents of the housing projects desperate to see their homes rebuilt, or the labor contractors who hope to get jobs.

“It’s as if the city is playing checkers, while Lennar is playing three-dimensional chess,” Eric Smith observed.

Lennar has stated that it will contribute $711 million to finance this massive project. The remainder will be leveraged by Mello-Roos bonds, state taxes based on the use and size of a property and intended to raise money for needed services, and tax increment financing, which creates funding for projects by borrowing against future property tax revenues.

The conceptual plan won Maxwell’s backing but environmental groups are critical of the draft EIR.

During DEIR hearing, environmentalists questioned the wisdom and the cost of filling the Bay to build a bridge over Yosemite Slough, and building condos on Candlestick Point state recreation area, the only open major open space in the district.

But the city’s Planning Department also has 20,000-30,000 units of housing in its pipeline. This means that if all these plans get approved in the next decade, they’d account for 80 percent of residential development citywide. And D10’s population could triple, further skewing the district’s already shifting demographics.

In other words, D10 as we know it could become nothing more than a historic relic in a few years, and the next supervisor will play a key role in deciding whether that happens. SFHDC’s Ed Donaldson warns that any supervisor who does not understand the complexity of the city’s largest district can expect a similar recall backlash in future.

“There is no one homogenous voice in the community,” Donaldson said. “The grass-roots organizing that brought about the recall effort was a result of a changing political structure in the area, but is not yet on par with other districts in town. We still allow our politics to be controlled from downtown.”

Fellow candidate Eric Smith warns that the issues—and politics—are complex.

“People were emotional, angry, and desperate because they feel no one listens to them,” Smith said. “That’s part of the problem here; they would rather have a supervisor go down swinging for them, rather than watch one seemingly side with Lennar, PG&E and the mayor on issues contrary to their interests. That’s the terrible irony and one of the biggest problems in District 10. Folks are so mad, they’re willing to do whatever it takes to make them feel they have a voice in the outcome, even if it’s potentially worse.”

Smith cited the sequence of events that culminated last year in the Navy dissolving the community-based shipyard Restoration Advisory Board (RAB), which for years has reviewed technical documents and commented on the Navy’s clean-up proposals. But in December, the Navy made its official decision to disband the RAB, citing dysfunctional behavior and off-topic discussions that got in the way.

“Some of the same folks who were frustrated by the process, tried to send a signal to the Navy that they weren’t being heard and for all their well-intentioned efforts got the RAB dissolved,” Smith said. “I truly feel for them, it’s absolutely heartbreaking, but at times, they can be their own worst enemy.”

One of the looming issues about the shipyard is that the land has been polluted and needs to be cleaned. The shipyard contains radioactive debris from ships towed to the shipyard, after a 90-foot wave washed over them during an atomic test gone awry. The Navy burned 610,000 gallons of radioactively contaminated ship fuel at the shipyard, and workers showered on the shipyard, raising concerns that radioactive materials got into the drains and sewers. And questions have been raised about radiological tests on animals at the yard.

 

LEAKS AND FLOODS

It’s not just the shipyard that’s toxic. Even the buildings that were constructed to house workers 50 years ago are a serious mess.

Realtor Diane Wesley Smith, who grew up in public housing projects, took me on a walking tour of Alice Griffith last week to see conditions that tenants will likely have to endure until at least 2014, if the city sticks to its plan to relocate people into a new replacement unit in the same geographical area, if not the exact same site.

What we found was pretty messed up.

“The water sometimes comes out brown and feels like sand. It’s been like that for a year,” one resident said.

“The water is cloudy, the bath tub isn’t working and the sink keeps stopping up,” said another.

A woman named Silvia showed us how the water from the tap in her elderly mother’s kitchen flows out cloudy and then doesn’t settle properly, like foamy beer.

“The roof’s been leaking for years, the sewage backs up, but they just fixed the lights,” Silvia said. A neighbor named Linda was using her oven as a heater.

“The toilet backs up a lot, and my grandson’s been coughing a lot from asthma,” Linda said.

“Roaches is always a problem,” said a woman named Stormi, dressed in black sweats and a black T-shirt that read, “Can’t knock the hustle.”

“They’re trying,” said Stormi, a member of the Alice Griffith Residents Association, as a couple of Housing Authority trucks pulled up to do repairs.

“They promise that you will not have to leave your unit, but if they try to move us down to the waterfront, well, there’s a reason there’s no housing there, and it’s because the land will flood,” Stormi said.

“If we don’t end up at the table, we’ll end up on the menu,” Wesley Smith warned, as she stopped to chat with a group of young men, who were worried they would pushed out of the Alice Griffith rebuild through the criteria being established.

“Fred Blackwell, the executive director of the Redevelopment Agency, assures me that’s not the case, but Alice Griffith is a Housing Authority property, and empty promises have the potential to be great promises provided they are made in writing,” Wesley Smith said as we walked out of the projects and onto the road where a yellow and black sign announced “flooded” next to Candlestick Point park, where Lennar wants to build.

Malia Cohen expressed concern about Hope SF residents, as we drove through the Sunnydale housing project.

“We have to be diligent and mindful that people are not pushed out,” Cohen said, noting the sweeping views at Gleneagles golf course above Sunnydale, and the value of housing for a golf course community. “When public housing gets taken offline, we must work with Redevelopment and the Housing Authority to make sure no one is changing the rules halfway. We have to make sure the talks and walks line up. We need to be equal partners. We cannot be bulldozed by City Hall.”

Geoffrea Morris is a Calworks employee, at the Southeast Community College facility on Oakdale, which was built to mitigate the city’s expansion of the sewage plant in 1987. She cited concerns about the literacy levels of people who live in the 2200 public housing units that cluster D10. “A lot of people in Alice Griffith don’t even know the dates or when it’s going to be reconstructed,” Morris said. “Folks like to be told stuff like that, but the city gives you a stack of papers. Some will read them, but others rely on folks they think are trustworthy. They need stuff in layman’s terms written on one sheet of paper.”

Morris is a fan of the Internet who posted a community survey online, and made sure every housing project got some literature telling people to get informed. She worries about the digital divide in D10:

“A lot of folks don’t have computers and access to important information,” Morris said. “And let’s talk about the way ‘affordable’ is used to trick people.”

Michael Cohen, Newsom’s top economic adviser, recently stated in a memo that over the expected 15-20 year phased build out, Lennar’s Candlestick-Shipyard development would include, “up to 10,500 residential units, about 32 percent of which (3,345) will be offered at below market rates.”

“But 892 units of this ‘affordable category’ will be sold to folks earning $100,000,” Morris said. “So if you subtract 892 units from affordable unit category, you’re back to 25 percent affordable.”

Candidate Kristine Enea, an attorney and a former RAB member, chairs the India Basin Neighborhood Association, which administers a US EPA grant to hire experts to translate the Navy’s cleanup documents into plain English and comment on them She was frustrated by the Navy’s decision to dissolve the RAB.

“The lack of a forum does nothing to bolster the community’s trust in the cleanup or the redevelopment process,” Enea said.

Enea generally supports the Lennar project, but has concerns about whether it will adequately mitigate increased car traffic, or result in commercial development that benefits her neighborhood.

“India basin is a pocket of Hunters Point right along the shoreline,” Enea said. “Right now, we have no shops or restaurants, no ATM, no groceries, nothing beyond one liquor store and a few industrial businesses.

Potrero Boosters president Tony Kelly told us that District 10 residents can think for themselves. “D10 residents don’t need to rely on corporations to solve their problems,” he said.

“Folks in the eastern neighborhoods came up with a better revitalization plan than what the city proposed and community activists managed to close the power plant, after the city said it was impossible,” Kelly recalled.

And there’s no shortage of good ideas.

Kelly suggested that an urban agriculture center could immediately put low-skilled folks to work by erecting greenhouses on unused land. Smith said the industrial zone could be “incredible eco-park made from sustainable sources.

‘D 10 is the dumping ground for everything, including all the city’s waste,” he said. “We could be a shining example, not just for D 10, but the rest of the state.”

The D 10 candidate line up includes Calloway, Cohen, Donaldson, Smith, Enea: civil rights attorney Dewitt Lacy, Morris, Potrero View publisher Steve Moss; District 7 BART director Lynette Sweet, Wesley-Smith. Bill Barnes, who works for Sup. Michela Alioto-Pier, and Linda Richardson, who was appointed to the Human Rights Commission in 2007 by Mayor Newsom, have also expressed interest in the race.

In such a huge field, name identification will play a major role. Sweet is in office, but BART Board is not a high-profile job and won’t give her a huge advantage.

Cohen has a slight edge right now in that she’s raised $18,505, including $500 from former Newsom flak Peter Ragone, making her the first D. 10 candidate to qualify for campaign financing. The oldest of five girls, Cohen recalls how her mother got laid off from her city job as a school-based mental health worker and then rehired, as part of the city’s budget cuts.

“We felt that pinch and the frustrating games that are played out between the leadership and the rank and file,” she said.

Cohen who worked for Newsom in his first term as mayor, but has since left his administration , said she is uncomfortable at being framed as Newsom’s candidate.

“Because I’m not, but I am one of the few candidates who has seen how the mayor and the Board work—and don’t work—together,” she said.

Moss sees the city’s southeast as a “district in transition.” Over coffee at Farley’s in Potrero Hill, he told me that the southeastern neighborhoods could be “launching pads for environmentally sustainable growth.”

“The district’s been in a frozen period for 30 years, But despite the problems, people are deeply committed to and in love with their community.

“This district is the future of San Francisco and its social fabric—the diversity, income –and its problems are leftovers from the city’s industrial age.”

An open letter to the Transit Workers Union

OPINION Last week, the Transit Workers Union refused to accept a deal with San Francisco that would have modestly reduced major service cuts and eliminated another increase in discount fares at least for this year. The proposal would have involved two things: first, a one-time contribution by drivers to their own pension plans (worth $8.9 million for next year, almost precisely cancelled by the automatic raise of $8 million the drivers will receive next year); and second, a change in work rules that would have required drivers to actually work 40 hours in a week before earning overtime, which would have saved $3.8 million over the next 14 months.

Muni is facing a deficit of at least $17 million in the current fiscal year and around $55 million next year. Future years will be worse. Given these pressures, the TWU is getting ready to re-vote. I presume that, eventually, union members will accept the deal. But either way, given how utterly marginal this deal is for the riders, progressives need to begin a public conversation about what responsibility the union has for making Muni work better.

The problem is not that TWU salaries are too high. The problem is the work rules. These include: drivers not having to let their managers know how long they will be absent from work, making it impossible to set schedules; drivers earning overtime pay before actually working 40 hours a week; and perhaps most significantly, a set of rules that makes it virtually impossible to hire part time drivers. Currently, Muni is forced by the work rules to pay drivers at full hourly rates to sit around between the morning and afternoon peaks. That rule costs MTA about $11 million each year.

If the TWU is willing to give on just the overtime and part-time driver rules, MTA would save $12.4 million in next year’s budget — and this savings would grow in the future. Other work rule changes could save much, much more, while dramatically increasing service to riders.

Probably the underlying cause of Muni’s work rules is the fact that the TWU, unlike other bargaining units in the city, has its salary and benefits set by formula in the City Charter — which means that management has nothing to offer during labor negotiations. Friends of mine in the labor movement argue that TWU is just doing its job in trying to get a good deal for members. I would argue that TWU needs to do more than that, and needs to begin taking responsibility for building a transit system that works well and can grow over time.

Maybe this public sector union needs to take a page from the Swedish labor movement.

Early into the post World War II economic boom, the Swedish unions learned that, since they controlled the government and increasingly controlled the boards of directors of the corporations they had organized, they were essentially always going to get their major demands met. This forced a big shift in their culture, causing them to have to take responsibility not just for cutting a good deal for their members, but for ensuring the profitability of the companies. Labor could easily “win too much” and drive the companies out of business, thereby returning its members to unemployment. Once labor controlled the businesses, it had to come up with a proactive agenda for how to run them successfully.

Closer to home, we’ve seen the teachers union accept cuts and changes to their equivalent of work rules in order to prevent teacher layoffs. And we’ve seen the Service Employees International Union at the national level put immense resources into passing health care reform — something that will benefit all Americans, not just SEIU members.

Something similar needs to happen now at Muni.

Muni workers deserve a good wage. It’s a hard job under the best of circumstances. And as Muni tries to keep service on the streets without enough money for equipment and maintenance, workers on the front lines will bear the brunt of the bigger problems. But a lot of people resent the things the union has chosen to ask for in addition to a good wage.

Muni’s troubles are multifaceted. They involve bad management, bad street design, bad land use planning, and certainly insufficient funding. But work rules are undeniably part of the issue as well. It cannot be progressive for the TWU, in the middle of the worst financial crisis to hit our country since the Great Depression, to cling to the same work rules it has had in the past. Muni needs TWU to help it be successful.

Why I love snowboarder girls

II mean, they’re really hot, of course, almost by definition.


But that’s not why I love the snowboarder girls. Here’s the thing (and it goes for the men, too; I just happened to be watching the women last night):


Every Olympics, every major competition, the boarders push the limits, try to do something they might not be able to pull off, and half of them fall, crash and burn, wipe out — and when they take off their helmet and goggles, they’re smiling.


It’s as if they love what they’re doing so much that it hardly matters if they just lost a shot at an Olympic gold medal.


It’s like, “dude — fuck the hardware. Did you see that sick move I almost landed? Whoa, I was like 20 feet above the pipe, man.”


For the snowboarders, it’s about the sport, not the winning. Sure, they’re intense competitors, but they also cheer each other on, and never play it cautious and just go out there and have a blast.


Compare that to the figure skaters, who are, of course, astonishing athletes and beautiful to watch — but they do their pre-scripted routines and seek perfection in planning and execution … and if they miss a jump or fall, it’s  as if the world has ended. They try to smile through the obvious pain and you almost don’t want to watch.


The boarders, though, they’re into the real Olympic spirit. Swifter, higher, stronger, dude! Party on.


 


 

Rambling Jerry Brown speech raises fear among Dems

If Jerry Brown’s keynote speech last night to a gala environmentalist dinner is any indication, the Democratic Party faces an uphill battle to win this year’s governor’s race. The rambling, alternately vague and academic, and often pointless address did little to inspire or excite a large, sympathetic crowd that was loaded with top Democrats. In fact, some party luminaries were openly aghast at the poor performance, with one making this succinct (if off-the-record) assessment: “We’re fucked.”

Brown has never been a dynamic speaker, but the unscripted, half-hour speech – given at the Sierra Club San Francisco Bay Chapter’s David Brower Dinner in San Francisco, a $250 per head affair that drew top Bay Area Democrats – illustrates the danger of letting a primary be decided by legend and money rather than political persuasion.

Brown’s fundraising prowess and strong poll numbers chased Gavin Newsom and other potential rivals out of the Democratic Party gubernatorial primary, even though Brown hasn’t really outlined his political vision for California, given many extended speeches since being discussed as a candidate for governor, or even officially declared his candidacy (he and others have until March 12 to do so).

“This thing is really daunting,” Brown said of the governor’s race toward the end of the speech, seemingly unsure that he was ready to run, but saying he would make an announcement sometime in the next couple weeks.

Brown started his speech by telling the crowd that he didn’t know what he was going to talk about, so when he arrived (late) for the speech, he asked San Francisco Democratic Party chair Aaron Peskin what he should say, and Peskin told him to talk about how there were more salmon in the streams and better overall environmental health back when Brown was governor in the ‘70s.

But rather than taking that advice and giving a forceful call to strengthen environmental regulation or conjure up California’s better days, Brown meandered around and mused on that and other topics, feeding fears that the 71-year-old candidate might come off as a nostalgic, slightly senile former-Governor Moonbeam rather than an effective agent of needed change.

“During that period when I was governor, I’m not going to call it the golden age because some people think I’m in the golden age, so I don’t want to get people confused. That’s why I don’t want to talk about way back then, because there are a number of people I can see weren’t even born then, so it gets a little embarrassing and I like to pretend it was just yesterday. But in that period, California created almost twice as many jobs as the nation did. We created jobs at about 24 percent over eight years and the nation grew jobs at 13 percent, so almost twice as much. And then Deukmejian did pretty good, he had about the same, maybe half a percent more,” Brown rambled, ticking off statistics, hedging his point by noting how little governors can really do to create jobs, before working up to a decent line that was flatly delivered: “It was a time when the environment got its biggest boost, as far as public policy.”

Nobody applauded, so he continued. “I was thinking tonight, I was trying to figure out that if I did announce, what the hell would I say? And so I decided to go back and read my first announcement, January 24, 1974. I was 35 then, it was another time, I’m now a little older than that. But I talked about clean air, I talked about the energy crisis and getting new sources of energy. I talked about statewide land use planning” – that last item drawing some applause – “and I talked about jobs. And I was thinking, wow, we still got a jobs problem, we got an energy problem, we have a land use problem that feeds into the energy problem, and while the air is cleaner in many respects, it’s not clean enough, or it isn’t healthy enough.”

On substance, Brown had his moments. But even on the need for better statewide land use planning, he went off on a tangent, saying he didn’t even know what that meant when he filled out a Sierra Club questionnaire back in the ‘70s, and he’s not sure how to accomplish it now. 

“You have to make it easier to live closer to where you work,” Brown said in what of his few lines of the night that drew applause, although he didn’t begin to explain how he might achieve this goal. And on a controversial subject that is easily attacked by the right – big government wants more control over private property – Brown’s lackadaisical discussion of the issue was disconcerting.

He even rankled a few Sierra Club members by vaguely criticizing East Bay growth controls designed to reduce sprawl, which the Attorney General’s Office is seeking to overturn: “Pleasanton wants to create 50,000 jobs, but they have a housing cap – for all I know, Sierra Club probably supported that housing cap, so I want to just rub your nose in the housing cap for just a minute – the trouble with the housing cap is they want to create all these jobs.”

Brown tried to argue that allowing more housing in Pleasanton is a strategy for combating global warming because there are jobs there and it would reduce commutes, but he’s going to need to be more on his game than he is right now to win that argument. Instead, we get his fairly dismissive summary of this important issue: “Land use is a big deal, it’s difficult, lots to do on that.”

Against businesswoman Meg Whitman, the Republican gubernatorial primary frontrunner, there is real potential in Brown’s basic belief that markets need to be regulated and that running the government isn’t just like running a business. And somehow, Brown will need to find a way to better distill and deliver that message to counter the right’s pro-business sound bites. 

“There are people saying business knows best,” Brown said, meandering off about companies and widgets for a minute before continuing his point. “But when you look at what we really have to deal with, it’s not just about economics and the market. It’s also about ecology and morality, and morality is about customs, it’s about traditions, it’s about our deepest patterns of how we all relate to one another and that can’t just be assimilated into market incentives. The market assumes honesty, you meet your promises, and also assumes there’s a framework, because things can just run off the cliff and that’s exactly what’s happening. As you add more people, you have more cars, and when you have more cars, they burn fossil fuel and what’s happening in California is you have cars reproducing faster than people…That’s the real challenge here, that we’re trying to get the idea out that we’re trying to save the future.”

Transamerica condos: the mystery continues

I’m not going to actually suggest that anyone watch all four hours-plus of the Planning Commission hearing last week on the highrise condo tower at 555 Washington. But if you’ve got the time, it’s a fascinating video.


And here’s what’s most interesting: A lot of the discussion revolved around what Commissioner Michael Antonini said was a need to continue the item to a later date. That’s because three of the commissioners — the ones appointed by the Board of Supervisors — were dubious about the project’s environmental impact report, so it would take all four of the mayoral appointees to let the project go forward. But Commissioner Gwyneth Borden couldn’t make the meeting. Antonini went ballistic at one point, and stormed out of the room, saying that it was disrespectful to Borden not to grant a continuance.
 
That struck Commission Vice-President Christina Olague as kind of odd. “I was taken aback by the accusations that we were somehow being insensitive,” she told me. “To my knowledge, Commissioner Borden never made any request for a continuance. There was nothing in writing and she never communicated it to me.”


But then the strangeness started to happen. Commissioner Hisashi Sugaya moved not to certify the environmental impact report on the project. That motion was defeated, 3-2, with Antonini off in a huff somewhere and Borden absent.


Now, normally, in these situations, the president looks for a substitute motion. In this case, a motion to approve the DEIR could have been made, and that, too, would have been defeated. Once the motion to approve went down, the DEIR would be scuttled and the developer would have to start again.


But instead, the commission secretary simply announced that the matter would be continued to March 18. And a week later, I’m still trying to figure out how that was possible.


After all, the commission had decided — openly, in public — NOT to accept a continuance. Then all of a sudden, without a vote of the body, Antonini got his way. The DEIR will be heard again, presumably with the mayor’s fourth vote present.


This is a major project, and I’m not going to argue that it’s fate should hang on an issue of procedure. But nobody has been able to explain to me how a matter gets continued without a vote to continue. The best I can figure is that without any motion on the floor, and no action pending, the secretary had no choice but to continue the matter.


“It all happened so fast,” Olague said. “I want to go back and review everything to see exactly what ocurred.”


Attorney Sue Hestor, who opposes the project, told me that after the lengthy list of serious flaws with the DEIR, which were presented in great detail at the hearing, it will be hard for the commissioners to certify the document. But the pressure from the Mayor’s Office is intense — Michael Yarne, the mayor’s Economic and Workforce Development advisor, was at the meeting, cornering commissioners outside. And four of the members serve at the mayor’s pleasure.

Two recent events could have major implications for Service Employees International Union Local 1021 — San Francisco’s largest public-sector union and an important ally for progressives — for better or for worse. And this union’s fate seems closely tied to that of the progressive movement in San Francisco.

The first event was likened to a “nuclear bomb in the morning paper” by one observer, and might be interpreted as the kickoff to a fierce budget battle. Mayor Gavin Newsom announced that he is considering a plan to help solve next year’s budget deficit by laying off 10,000 full-time city workers and rehiring them at 37.5 hours, which would amount to a sweeping 6.25 percent pay cut for workers and an estimated $50 million in savings for a fiscally impaired city.

Though it was framed by Newsom spokesperson Tony Winnicker as one preliminary cost-saving option among many, the proposal received prominent front-page coverage in the San Francisco Chronicle, even before official discussions were called between the mayor and public sector unions. Since SEIU Local 1021 represents 17,000 members in San Francisco and a majority of the city’s 26,000 total employees, it would likely absorb the greatest impact if such a plan went through.

At the same time the mayor’s startling announcement hit newsstands, SEIU was in the midst of mailing out ballots to its membership for union elections. “I don’t know whether it’s a coincidence, or if the city is taking advantage of the fact that SEIU is absorbed in its elections,” Sin Yee Poon, an SEIU chapter president for Human Services Agency workers, told us while pointing out that the events happened simultaneously.

With three separate slates of candidates vying for control of SEIU Local 1021, grudges between warring internal factions have intensified into bitter sparring matches. The timing is unfortunate — just as SEIU’s internal turmoil is coming to a head, one of its greatest battles is pending over an unprecedented $522 million budget shortfall that looms like a dark cloud over the city. The deficit will surely result in job losses, and the public sector union’s ability to mount resistance even as it wrestles with internal strife is shaping up to be a key question.

This pivotal moment carries wider political implications considering that the progressive organization has in the past helped seal an alliance between San Francisco’s left-leaning leaders and organized labor through the San Francisco Labor Council.

With SEIU besieged by infighting and soon to be hurting from wage slashes and layoffs, more conservative factions of the labor community, such as the San Francisco Firefighters Union and the Building and Construction Trades Council, have recently been butting heads with progressive members of the Board of Supervisors.

At the same time, forces on all sides are beginning to eye the coveted seats up for election in June at the Democratic County Central Committee, a Democratic Party hub that is a cornerstone of local political influence, as well as the seats that will open up on the Board of Supervisors in November. Negotiations between unions and the mayor are ongoing, and mayoral spokesperson Tony Winnicker was quick to note that Newsom is open to options, other than reconfiguring 10,000 city jobs, that organized labor brings to the table. At the same time, the Guardian heard from numerous sources that city workers felt outraged and blindsided by Newsom’s decision to air the plan in the Chronicle instead of bringing stakeholders to the table.

SEIU Local 1021 President Damita Davis-Howard told us she thinks the idea of taking $50 million out of the pockets of working people in a rocky economy is wrong-headed.

“This was devastating,” said Davis-Howard, who is running for a newly created union position called chief elected officer, which is different from the union president, and similar to an executive-director post. “The mayor might as well have raised their taxes, because if you decrease their pay by 6.25 percent, they will still have the same amount of work, they will still have to pay the same mortgage, they will still have to buy the same food, the same PG&E, and they’ll be doing it with a lot less money. If any idea like this were to go through, it would actually remove the very fabric or fiber of San Francisco. It would really cut to the core of the very being of San Francisco. … I don’t see how anybody could believe that we could continue being the city that we love being with this kind of action.”

Winnicker, the mayoral spokesperson, cast it as a plan that could avert hundreds or even thousands of layoffs. “This year the easy decisions are behind us,” he noted in a recent discussion with the Guardian.

Solving last year’s fiscal shortfall was far from easy — budget tussles between frontline city workers and the mayor got ugly, and even then, the city received millions in federal stimulus dollars to cushion the blow. A similar plan of sweeping hourly cuts was floated then too, but it didn’t gain enough traction to move forward.

“The mayor is facing a huge budget deficit, there’s no question about it — but he has not lifted one finger to raise a dime in revenue,” charged SEIU member Ed Kinchley, who works at San Francisco General Hospital. As for how the union might respond if such a proposal went through, he speculated, “I think it’s the kind of thing that could lead to a strike. A big fight.”

While the city charter bars strikes by public employees, Kinchley’s comment indicates the level of frustration among SEIU’s rank-and-file.

 


 

The proposal could present a common enemy and a rallying point for a union in disarray. Internal jockeying for elected positions can be fierce in any organization, but for San Francisco’s service-workers union, the rifts are particularly deep.

The elections, which will be decided Feb. 28, mark the first time since a radical restructuring in 2007 that members will collectively decide who should lead. In 2007, the face of SEIU was changed across California when the international president, Andy Stern, began consolidating dozens of far-flung locals into centralized, beefier entities in a bid to maximize political effectiveness (California comprises roughly one-third of the entire union’s membership).

Local 1021 came into existence when 10 locals were conglomerated into one 54,000-member giant — hence the “10-to-one” label — representing health care and frontline service workers from the Bay Area to the Oregon border. 

In San Francisco, where a large segment of its members are based, the shift was interpreted by some as a power grab, and it triggered a period of ongoing strife between those allied with Stern and the international wing on one side, and those dissatisfied with changes they saw as antithetical to the democratic ideals championed by Local 790, its predecessor, on the other.

In the years following the reorganization, Stern began trying to aggregate members by raiding other unions to consolidate power. But campaigns to bring in members from United Healthcare Workers (UHW) and fend off membership losses to the newly created National Union of Healthcare Workers (NUHW) have consumed money and resources that some members told the Guardian would’ve been better spent bolstering national support for health-care reform and the Employee Free Choice Act. According to one source, SEIU spent $10 million on a Fresno battle against NUHW.*

A fight waged between SEIU Local 1021 and UNITE HERE Local 2, a hotel-workers union that was historically allied with Local 1021’s predecessor, left some members especially stung because it marred a longstanding relationship between two groups of frontline workers.

“Andy Stern has concentrated more and more power into the hands of a group of so-called elite members of the union,” Kinchley told the Guardian. Stern’s top-down leadership style and growth-oriented objectives “run pretty harshly against what many of us believe is in the best interest of our workers locally,” he added.

In recent weeks, divisions have deepened further. A staff person who preferred not to be identified for fear of retribution filed charges with the U.S. Department of Labor against a supervisor, who is aligned with the international faction, for alleged harassment and bullying. Another complaint was filed with union leadership alleging that union bylaws were violated when membership money was authorized, but not spent, to conduct a poll without proper approval.*

“There’s a fiscal rogue-ness about it. [Davis-Howard] does whatever she wants, and she spends our dues money without authorization from anybody,” Kinchley charged.

Stern appointed Davis-Howard, and now she is running for election on a slate aligned with the international wing. When the Guardian tried to reach her to discuss union elections, spokesperson Carlos Rivera told us that Davis-Howard found it inappropriate to publicly discuss internal divisions.

Sin Yee Poon is running as her opponent on a reform slate, formed by members disaffected by the international’s modus operandi. “For the whole reform group, we’re disappointed with the general direction of corporate unionism,” Poon told the Guardian. Stressing that she believes grassroots, democratic ideals have eroded since the restructuring, she said members in her camp are agitated when they see resources siphoned into raids on other unions such as UNITE HERE and UHW. “We want it to be member-driven,” she said. “The raiding of other unions is absolutely not OK.”

 


 

The internal strife could have a wider ripple effect. SEIU Local 1021 has historically been influential in securing an alliance between the city’s labor community and San Francisco’s progressive leadership. During the last round of elections for San Francisco’s Board of Supervisors, Sups. John Avalos and Eric Mar campaigned and ultimately were elected with strong fundraising support from the labor council.

Yet in recent weeks, several skirmishes pitted certain factions of the labor community against progressive members of the Board of Supervisors. Outrage bubbled up from the firefighters — and ultimately the labor council as a whole — against a charter amendment proposed by Sup. John Avalos that would have extended the minimum number of work hours for firefighters.

Billed as a cost-saving measure, the proposal might have ultimately resulted in fewer firefighter jobs, but it was designed to spread the pain of budget cuts more equitably by grazing public safety departments instead of just inflicting blows on frontline and healthcare workers.

After Labor Council Executive Director Tim Paulson came out strongly against it, Avalos abandoned the idea. A source from within the labor council, who spoke on background only, described it as an opportunity for the labor council to come together and unite on class interests.

The political posturing that came out of that fight shook even Sup. David Campos, who vocally called for equitably sharing the pain during last year’s budget debacle. “This isn’t the way to do it,” Campos said when asked about Avalos’ failed charter amendment. “And I worry about the negative impact on labor and the progressive board. There are larger issues at play here. The entire progressive agenda is at stake. We need to think long-term about the specific issues plus the future of the progressive movement.”

Sup. Sean Elsbernd’s bid to reform the pension system to save money has provoked yet another fight with SEIU Local 1021. Union members argue that if they are asked to contribute to their own retirement funds, which would become mandatory under this proposal, then they should be given the same wage increase that other unions were granted when they agreed to similar terms.

But when Sup. Eric Mar tried to amend Elsbernd’s proposal by inserting language guaranteeing that pay increase, Elsbernd said it would cost the city millions more. If Mar’s amended version goes forward, “you’ll be going to the voters by yourself,” Elsbernd told the progressive-leaning supervisor at a Feb. 9 board meeting.

 


 

Another fight has erupted over 555 Washington, a tower proposed to go up beside the TransAmerica Pyramid, which was debated at a joint hearing Feb. 11 between the Planning Commission and the Recreation and Park Commission. For members of the Building & Construction Trades Council, which represents unionized carpenters, plumbers, and other workers in development-related trades, the project represented jobs — the screaming priority in an economy where funding for new construction has trickled to almost nil.

“There is, in general in San Francisco progressive politicians, a knee-jerk reaction to development projects,” Building & Trades Council Secretary Treasurer Michael Theriault told us. As a council representing people whose livelihoods depend on private sector construction, “We have a particular quandary,” he said. “We need politicians who at the same time are friendly to labor and understand that development is an economic tool that can help the city.”

The arm of labor representing Theriault’s council has been slammed with job losses due to the economic downturn, and he’s publicly expressed frustration when projects of this scale are shot down.

“What the mayor did, what Elsbernd did, and what Avalos did are all the same thing: They all staked out a position, put a provocative idea on the table, and forced unions to have a discussion with a gun to their head in a non-constructive way,” Mike Casey, president of UNITE HERE Local 2 and a member of the labor council’s Executive Committee.

A source familiar with the inner workings of the labor council said the tension between building trades and firefighters versus more left-leaning members of the labor community has been in existence for decades, and it isn’t anything new — particularly in the months preceding election season.

Casey challenged the very notion that there is a subculture of the labor council that isn’t progressive, pointing out that labor came together as whole to support Sups. Avalos, Mar, and David Chiu — “and I personally would do it again in a heartbeat,” he added. Internal catfights and struggles for control come with the territory in a democratic, diverse organization, he said. “As a group of working people, I have great regard for the membership [of SEIU Local 1021],” he said. “Occasionally there’s a dustup. In my experience, after the dust settles, more often that not, unions come out stronger for it.”.

Showdown over a downtown highrise

The battle over 555 Washington — the too-big highrise that will house 248 luxury condos that San Francisco doesn’t need — is going on right now, and you can watch it on sfgtv. 

Supporters and opponents have been testifying for more than two hours. Sue Hestor mae one of the key points toward the end of the testimony: Does “new urbanism” say that we have to fight suburban sprawl by putting 400-foot buildings everywhere in San Francisco?

She also pointed out that the building has so much parking that the lines to get in and out of the underground garage will impact the only downtown fire station, a block away.

Already, Planning Commissioner Hisashi Sugaya is arguing that the EIR on the project is completely bogus and invalid (although he carefully avoiding saying he will vote against the project).

This is one of the major development battles of the year, and will demonstrate whether the Planning Commission and Recreation and Park Commission have the independence and integrity to reject a project the mayor and the Chamber of Commerce support.

 

UPDATE: The hearing ended in the strangest way. After more than two hours of testimony — most of which showed the inadequacy of the EIR, which has to be certified as complete before a final vote on the project itself — Sugaya moved NOT to certify the document. That motion failed, 3-2. At that point, the commission secretary said that the matter would be put off until March 18th.

The strange thing is that if the motion had been in reverse – a motion TO certify — that also would have failed (either way, four yes votes were needed, and two commissioners weren’t there). And then the matter would be over; the EIR would not be certified, and the developer and city planning dept. would have to go back and redo it. In this case, since a motion to reject failed, and there was no motion to accept, it’s not clear where the EIR is.

Aaron Peskin, a foe of the project, told me just now that he doesn’t see how the commission can legally continue the hearing. “There’s nothing to continue,” he said. “There’s no certified EIR.” That, in the end, will be up to the city attorney. I’ll keep you posted. 

“Whatever happened to my sanctuary city amendment?”

Yesterday, Sup. David Campos called for a status report on steps taken by San Francisco’s Juvenile Probation Department to implement an ordinance that the Board passed last fall to protect the confidentiality of juveniles’ immigration status.

And it already sounds like JPD has done nothing to implement it—and isn’t planning to, either, any time soon.

Campos announced that he met with Juvenile Probation Department (JPD) Chief William Siffermann today, and Siffermann told him that he had no intention of complying with the ordinance, which the Board passed Nov. 10, 2009.


JPD has had three months to figure out how best to implement the ordinance, which Campos helped author last year, and which seeks to give kids their day in court before handing them over tofederal immigration authorities for possible deportation.

Campos said he called the hearing so all the folks who worked to pass the legislation, and those it impacts, “have a public forum to hear about the decision not to implement it.”

Campos also requested a report on the impacts of JPD’s current policy towards suspected undocumented juvenile felons—a policy that Newsom ordered without public review and that JPD implemented on August 2008.

The report, Campos said, will include but is not limited to, the following:

1.    Determinations of cases of undocumented immigrant youth—original changes and final determination by the courts.

This will involve exploring not only what these youth were originally charged with at booking, but also what the local juvenile courts ultimately determined in their cases. So, expect to see a pattern in which the courts throw out or reduce the charges that resulted in these juveniles being reported to the feds at the moment of booking. Only, by the time the courts reach this determination, these kids have already been nabbed by the feds and transferred to detention facilities outside the city and/or state—a practice that has already resulted in the needless ripping apart of immigrant families.

2.    Policies, procedures and training provided to staff regarding inquiry into the immigration status of youth and compliance with the 1989 City of Refuge ordinance.

This exploration will likely lead to some eye-opening revelations as to how juvenile probation officers are expected, under the policy that Newsom ordered in 2008,  to question youth suspected of being undocumented, and how that contrasts/compares with the city’s original sanctuary ordinance which the Board implemented in 1989.
3.    The numbers of undocumented immigrant youth that have been reported to US Immigration and Customs Enforcement (ICE) since Newsom ordered his change in sanctuary policy direction in 2008.

Up until now, it’s been almost impossible to discover exactly how many kids the city has handed over to ICE under Newsom’s new policy. Yes, even though the city is now spending local tax payer dollars to hand local immigrants’ kids over to the feds, the city has not told the public how many kids have been handed over or their current whereabouts. This information, coupled with information about the final determinations that local courts made in these kids’ cases, will likely be another mind blower.

4.    Changes in caseload and staffing as a result of implementing Newsom’s new sanctuary policy direction in 2008.
Again, expect to see some interesting patterns emerge. Has the city saved money by referring kids to ICE at the moment of booking? How about time? And just how well trained are juvenile probation officers in the intricacies of immigration law, anyway?

5.    Information about department financial and human resources dedicated to collaboration with ICE.

This is where the proverbial shit may truly start hitting the fan. Are we needlessly alienating the immigrant community?  Are we doing so in counter productive ways?

As chair of the Rules Committee, Campos promised to schedule this hearing as soon as possible, so watch the Board’s committee calendar and expect to see sparks fly.

Sunshine and shadows

It was, the San Francisco Chronicle proclaimed, the end of the world for development in the city, or at least something close to that. A ballot measure, sponsored by Sup. David Chiu, restricting new buildings from casting shadows on city parks “could imperil major development projects,” a Jan. 28 article by John Cote said. “Everything from a new wing at the San Francisco Museum of Modern Art to the expansion of the Moscone Center and creation of a new downtown core around a rebuilt Transbay Terminal could be affected.”

A lot of that is wildly exaggerated. The Chiu ordinance, which has since been pulled from the ballot pending a city study of the issue, would hardly have halted all development — or even all high-rises — in San Francisco. It wouldn’t have gutted the Transbay Terminal plan (although it might have forced planners to reduce the height of a tower that would soar 400 feet above the tallest building in San Francisco). In fact, the real story is how Chiu has managed — for now — to stop a backroom attempt by developers to undermine a 25-year-old environmental law. We found some fascinating evidence of how Mayor Gavin Newsom has been working with the San Francisco Chamber of Commerce to undermine Chui’s efforts — using broad threats to try to get his way.

Chiu’s legislation sought to clear up a couple of loopholes in a landmark 1984 law, which passed on the ballot as Proposition K. The measure, authored by then-Sup. Bill Maher, essentially barred any new construction that would cast a significant shadow on a city park.

In 1989, the final implementation guidelines were approved, and they’ve stopped literally hundreds of proposed projects from casting dark shadows on public open space.

But in the past year, city planners have been meeting with lawyers for big developers and looking for a way to change the rules. Citing new technology that better measures the curve of the earth and complex algorithms that calculate sunlight, the Planning Department has since proposed revising the Prop. K guidelines — in a way that would allow taller buildings and more shadows without getting the approval of voters or supervisors.

Chiu told us he’s been trying for months to find out exactly what the proposed guidelines would do — how many new buildings, at what heights, would be able to shadow which parks. “I was unable to get any answers,” he said.

The measure he drafted would have barred any new guidelines that allowed more shadows — and would have required the Board of Supervisors to sign off any changes. It would still allow the city to make case-by-case exemptions for projects that cast minor shadows but are otherwise deserving of approval — affordable housing developments, for example.

But downtown went nuts — and Newsom joined the fray.

The crux of the opposition came from the Chamber — and is outlined in an e-mail from Chamber Vice President Rob Black to members of the Chamber board.

“The mayor was very direct and clear about the need to defeat the measure,” the e-mail, which we obtained, states. “The mayor was also very clear that he was in no mood for deal-making on the issue and that he would look very unfavorably on any developer or anyone else who tries to cut a deal with David Chiu on the issue. He literally said, you will be on your own for the next two years if you go there.”

Black confirmed that the e-mail was in fact his — but said the version we’d obtained “has been edited. Some words were changed and other omitted.” He refused to say what the changes were, saying that the e-mail was meant to be a confidential communication to his board. However, he confirmed that the basic message and descriptions of a meeting with Newsom were accurate.

Tony Winnicker, Newsom’s press secretary, confirmed that Newsom had been directly involved in trying to scuttle the ordinance — and didn’t deny the mayor had made those threats.

“The mayor made clear the importance of asking the supervisor to withdraw the measure,” Winnicker wrote in an e-mail to us. “The mayor was clear that backroom deal-making should not be tolerated on the issue.”

Chiu was somewhat aghast at the mayor’s statements. “The context for all this is that the developers and their lawyers were trying to change the rules,” he said.

Aaron Peskin, the former supervisor and longtime North Beach neighborhood activist, told us that the “hysteria around this is factually untrue. This isn’t about stopping development — it’s about making sure development doesn’t have an adverse impact on the city’s common space.”

So now Chiu has agreed to hold off — but only if the key stakeholders (not just developers) have some input into how planning devises new shadow rules. And he’s ready to go back to the ballot in November if the developers try to play games again.

That makes sense, Gabriel Metcalf, executive director of the San Francisco Planning and Urban Research Association, told us. “There should be a heavy burden of proof on the people who want new rules,” he said. “And there should be a heavy burden of proof for anyone who wants a ballot measure.”

In other words, Prop. K — as it is, as it’s stood all these years — is working pretty well. And if the developers hadn’t tried to sneak in some big changes, none of this would have happened in the first place.
