Out with the old

It may seem odd that the loss of a two-story vacant building would ruffle so many feathers, spur multiple phone calls to the police, and inspire a push from Board of Supervisors president David Chiu to make changes to San Francisco’s building code. But the March 16 demolition of the Little House, a 148-year-old Russian Hill cottage on Lombard Street, struck a nerve and raised a slew of questions — many of which continue to go unanswered.

Controversy may have started swirling because a property that has stood since Abraham Lincoln’s presidency was razed with scarcely a week’s notice on a swiftly issued emergency-demolition permit. It might also have been because the co-owners of the property, Michael Cassidy and James Nunemacher, represent the high-profile Residential Builders Association and the real estate firm Vanguard Properties, respectively — both politically well-connected entities that have been behind projects in the past that drew criticism from various citizens groups.

The Little House, which previously stood at 1268 Lombard St., was by some accounts one of the 10 oldest homes in San Francisco. Under the California Environmental Quality Act, a building of that age would normally require an environmental impact report before the Planning Department can issue a demolition permit. According to Department of Building Inspections spokesman William Strawn, the emergency demolition permit was issued after a structural engineer who had inspected the property on behalf of the owners sent a letter expressing concern that it was in danger of collapse. DBI staffers, including department manager Ed Sweeney, inspected it, and Strawn said the permit process started once they concluded that it presented a safety hazard.

Word that the cottage would be razed sparked an outcry from a group of concerned neighbors and historic preservationists, including architect F. Joseph Butler, who says he discovered it 15 years ago when he learned that it was one of the few structures on Russian Hill to escape the 1906 earthquake and ensuing fires. Butler says he doubts the building was in danger of collapse, and says he tried in vain to convince DBI to allow him to bring in a third party who could offer a second opinion. When asked about that possibility, Strawn said, "The building department would not rely on a third-party source."

The building was torn down March 16, with tensions simmering in the days leading up to it. When a demolition crew showed up March 9 ready to go to work, several days before the emergency permit had actually been issued, a neighbor who was trying to save the cottage phoned the police to halt the demolition. Police reports show that a few days later when the crew arrived on the property and were greeted by a small group of protesters, the cops were called twice more — by both sides. Joe Cassidy, Michael Cassidy’s brother and a prominent member of the Residential Builders Association, is the president of the demolition company.

Protesters charged that the building was neglected on purpose to hasten its demise, so the owners could skirt the regulatory EIR process. "It appears the property owner has exceeded the scope of their permit to replace dry rot by structurally damaging the building and claiming it is in imminent danger of falling down," Cynthia Servetnick, an architect with the SF Preservation Consortium, wrote in an e-mail to the City Attorney’s Office not long before the demolition. Building Commissioner Debra Walker, who also inspected it, noted that "the windows were out, and the doors were out in the back. It looked to me like people had just left it open."

Megan Allison Wade, who blogged about the demolition of the Lombard Street house, wrote in an e-mail to zoning administrator Larry Badiner that she perceived "a very clear case of willful neglect in an attempt to degrade the property into demolish-able condition."

Badiner responded: "This emergency demolition permit supersedes historic preservation and housing preservation procedures. … Without commenting on whether this is willful neglect, public safety would trump any concerns regarding how the building became unsafe."

An article published by the San Francisco Chronicle noted that Nunemacher denied that he and Cassidy had neglected the property. When we called Nunemacher to ask him directly, the conversation didn’t go so well. He said he was busy, and told us to read the other news reports. When asked if this meant he didn’t want to comment, he said, "You are putting words into my mouth. I don’t like what you are doing." Then he threatened to call the police.

Whether or not the property was in fact neglected on purpose is a question that may never be answered conclusively. City Attorney’s Office spokesperson Matt Dorsey told us he was not at liberty to say whether an investigation is underway, but it’s clear that any investigation would have to go forward without a crucial element — the house.

Attorney Arthur Levy made a last-ditch effort to try to save the Little House just before it came down, sending a letter transcribed on his office’s letterhead to a list of city department heads. "What makes San Francisco different is our built environment," Levy says. "It seems to me that when a property owner willfully neglects a building, and that results in demolition … there ought to be some consequences."

For some of those engaged in the fight over the cottage, the incident brings to mind past controversies involving the same players and others close to them. When an historic Victorian shipwrights’ cottage at 900 Innes Ave. — which the city designated as a historic landmark last year — was under the ownership of developer Joe Cassidy, he had plans to demolish it and build condos, retail space, and a kayak center. In that 2005 battle between the RBA developer and preservationists, the preservationists won.

Another project that involved both Joe Cassidy and Nunemacher was a residential development at Fourth and Freelon streets. At the time that project was being permitted, one of the top-selling agents at Vanguard Properties, Jean-Paul Samaha, worked as a liaison between the Board of Supervisors and the Planning Department. In 2005, architect Kepa Ashkenasy lodged an Ethics Commission complaint against Samaha alleging he had failed to disclose a $100,000 loan from Nunemacher, who had been his romantic partner at the time, even when he was in a position of testifying before the Planning Commission in his professional capacity about the Fourth and Freelon development, Ethics records show.

The complaint was dismissed after Samaha lodged a counter-complaint against Ashkenasy with the Human Rights Commission, noting that loans from spouses and domestic partners are exempt from financial disclosure rules, and charging that her allegation was motivated by a kind of homophobia, a HRC document shows. Ashkenasy told the Guardian that she only sought to illuminate a conflict of interest — and added that she is a lesbian.

Servetnick said the case of the Little House highlights a broader issue of vacant historic properties throughout the city that are allowed to go to waste because it’s more profitable to knock them down and build new. Draft legislation introduced by Board President David Chiu seeks to address this concern by requiring owners of vacant properties to register their empty buildings with the city so that inspectors can play a more proactive role in detecting problems before it’s too late.

At a March 26 Planning Commission meeting, Charles Marsteller, former head of government watchdog group Common Cause, told commissioners he had attended the demolition of the Lombard Street cottage. When it came down, he says, he realized how unique it was and earnestly told planning commissioners that he thinks the Little House should be reconstructed, and the lot turned into a park.

As for the demolition, "It was just a put-on by some insiders in City Hall working the network that they normally work," Marsteller says. "And it shouldn’t have happened."

It was hard in the good old days. Back when we were young and San Francisco was cheap and I was really cool with my long hair and motorcycle and stuff. You could rent an apartment for $200 a month, and even though we weren’t making much money in those days, there was plenty left over for drugs.

Back then, a guy like me would never have respected a politician like Gavin Newsom. You know: Party pooper. High-society twit. He even blamed his drinking for his tawdry affairs; we always though our tawdry affairs were the best reason for our drinking. And we never went into rehab. How, like, Betty Ford can you be?

But now I’m older and have a family and take cholesterol medication and I’ve come to realize how much I like Gavin Newsom. I mean, I don’t like him, not all Beth Spotswood or anything, but he’s growing on me.

I remember when he was running for reelection, and he came down to the Guardian to talk to us, and I asked him why he should get another term when the city was so eminently fucked up, and he said: "Gee, why did I even bother to get up this morning?"

That’s the kind of question you’d never hear Jerry Brown or John Garamendi ask. They know why they got up this morning; they are past the time of wonder and self-doubt.

Old farts is what they are.

So this week we endorse Gavin — Our Mayor — for governor of California. You won’t read that in SF Weekly — they don’t even do endorsements, pathetic little shits.

In other news, I’m happy to announce that the Guardian has settled its lawsuit with SF Weekly and Village Voice Media.

Clint Reilly calls the San Francisco Chronicle “the greatest wealth destruction machine in American journalism today.” It’s an interesting hit on the situation; he cites a Wall Street Journal interview with investment banker (and media industry expert) Jonathan Knee, who notes:

The reason why most newspaper companies have gone bankrupt or appear perilously close to it is that they have too much debt, not that they have stopped being profitable. For the reasons I have already described, they are certainly less profitable than they used to be, but compared to most media businesses like movies and books, most newspapers still have higher profit margins. Unfortunately, many of these companies maxed out on available debt during a bubble in the debt market just before the debt bubble popped and their own profit margins precipitously declined. That does not mean that these companies cannot continue to generate significant cash flow once restructured into a sustainable capital structure.

Then points out that Hearst’s problem isn’t debt — I suspect the bean counters have already written off as a tax loss most of the $700 million the company paid to buy the Chron. The problem, he argues, is bad management:

With more than 75 percent of its circulation outside San Francisco, the Chronicle is unable to cover The City or the suburbs in depth. The paper’s circulation should have been cut in half many years ago; at 360,000, it remains massively expensive to produce, print and circulate. Resizing alone might have saved the paper by dramatically reducing operating costs across the organization.

All of which, of course, argues against Rep. Nancy Pelosi’s plan to eliminate anti-trust regs and allow the Chron to merge with, say, Dean Singleton’s Media News Group.

Debuting less than two weeks ago out of warehouse in Dogpatch is Kitchenette, a project from chefs who’ve worked at places of such high caliber as Incanto, Chez Panisse and Foreign Cinema, creating daily offerings that are, you guessed it: fresh and seasonal. Check the website for the changing menu which usually consists of a meat and vegetarian sandwiches (occasionally pizza), a salad, fresh juice and cookie. Last week I was converted by the fabulous Bahn Mi-like sandwich of beer & tangerine roasted Berkshire pork ($8) with cilantro, jalapeno, cabbage plus a side of macaroni salad. Washed down with a tart Meyer lemon, tangerine, blood orange juice ($2), I was already planning my next visit. Bring your cash (no other option) and come early because once their daily creations of lunchtime goodness are gone, well… they’re gone.

Fine dining made more affordable at La Folie’s Lounge
San Fran’s 21-year old French fine dining mecca, La Folie, may not be cheap even in lounge form, but if I don’t have to pay $70 to $105 for the only option of tasting menus in the dining room, I can still make a night of it ordering a la carte in the next door lounge, opening March 31 during their 21st birthday party. You can now eat as little or as much as you wish of the Michelin-starred food given a lounge-twist (think Lobster Croque Monsieurs), cocktail in hand (note: the bar is helmed by Casper Rice of Michael Mina and Rubicon).

Cafe Altano, a casual, new restaurant in Hayes Valley
Hayes (Valley, that is) is home to a regular foodie row with primo sushi, German food, coffee and chocolate within a couple blocks. Guild corrects SFBG, invites freelancers to join union

Carl Hall, the Chronicle’s California Media Workers Guild representative, just emailed me, regarding my article in today’s newspaper about the future of journalism

Hall wrote to point out that I had inaccurately reported that the Guild has “voted to accept 150 layoffs and accept seniority considerations” at the Chronicle.

But as Hall notes, “Our contract like most guild contracts does not contain any prohibition against layoffs, and there’s not been any requirement that the employer obtain our agreement before laying anyone off. We voted to lift seniority protection against layoff in exchange for severance – that’s the new part. We also voted a number of other changes to reduce costs one way or another.”

“One other detail you might not realize,” Hall continued, “is that the Guild contract already had a provision allowing the management to protect up to 25% of low-seniority employees in a layoff round, meaning they could keep those individuals because of their importance in the operation and lay off more senior employees instead.”

Hall said he was saying all this because he continues to see, “everybody claiming that we voted to accept layoffs, when in fact we did not.”

“The company told us they were prepared to implement layoffs of about 225 of our members, with no severance, or close the paper or sell it, in which case all 500 of us would risk being laid off, with no severance,” Hall explained. “Maybe we could have chosen some suicidal path of bluff-calling or whatever, but our members chose the path we are on — a selfless choice for the senior people who nearly all voted to open themselves up to more individual layoff risk for a mere one year’s pay.”

“As a union however we did not vote to accept 150 layoffs,” Hall stated. “ We expect that number will be laid off because of this management’s short-sighted, destructive business plan and failure to make the Chronicle thrive as a top-quality paper, in print and online. I don’t hold any particular ill will toward the Hearst Corp., and credit them for the patience they have shown over these past few years when they’ve tolerated purported losses far exceeding those being reported elsewhere.”

Hall ended by saying that he was, “encouraging our members and the entire community to focus on what truly matters — quality jobs and quality journalism, and yes we do see a quality connection between the jobs and the journalism. (i.e., no reliance on “volunteers” or low-paid exploited at-will news workers, such as may be the case at the anti-union outfits such as — cheap shot alert! — the SFBG.)

“In a word, here’s the plan,” Hall stated. ” Organize! If you want to start, we will show you how.”

Employees at the San Francisco Chronicle are anxiously awaiting the March 31 deadline that its owner the Hearst Corp. has set for accepting buyout offers, after which the ax could fall on any employee at any time. The California Media Workers Guild has voted to accept 150 layoffs and to end seniority considerations at the city’s major daily.

Hearst claims that amendments to the union’s contract are essential to avoid closing or selling the 144-year-old paper, although the company refuses to open its books, making it impossible to verify claims that the Chronicle is losing $1 million a week. Rather than challenging that corporate prerogative, Speaker of the House Nancy Pelosi wants to explore allowing a local monopoly like MediaNews to buy the Chronicle, the last major Bay Area newspaper MediaNews doesn’t already own through its Bay Area News Group subsidiary.

In a March 16 letter to U.S. Attorney General Eric Holder, Pelosi wrote: "I am confident that the antitrust division, in assessing any concerns that any proposed mergers or other arrangements in the San Francisco area might reduce competition, will take into appropriate account, as relevant, not only the number of daily and weekly newspapers in the Bay Area, but also the other sources of news and advertising outlets available in the electronic and digital age, so that conclusions reached reflect current market realities."

Holder responded March 18, telling reporters, "It’s important for this nation to maintain a healthy newspaper industry. So to the extent that we have to look at our enforcement policies and conform them to the reality that the industry faces, that’s something I’m going to be willing to do."

Sara Steffens, chair of the Guild’s Bay Area News Group East Bay unit, recently raised her concerns about that strategy. "Consolidating some or all Bay Area News Group operations with the Chronicle could prove the financial salvation for our struggling newspapers, potentially guarding against bankruptcies or outright shutdown," she wrote on the union’s Web site. "But it could also pave the way for further job loss and erosion of standards."

Justice department lawyers have in the past ruled against mergers that created newspaper monopolies, but media analyst Alan Mutter believes times have changed. "It’s just a question of who is going to qualify," Mutter told the Guardian.

Retired UC Berkeley journalism professor Ben Bagdikian, author of books critical of media monopolies, said the Chronicle‘s "surprising announcement" that it might have to shut down could be a scam. He notes that this news comes "not long after Hearst and [MediaNews owner Dean} Singleton, who owns all the East Bay dailies, formed a partnership to buy media in other parts of the country.

"Hearst a few years ago — granted, in boom times — gifted the Examiner to the Fang family along with a stunning gift of $56 million to the Fangs to take it and make it into a daily," Bagdikian said. "I think it has never before happened in the news business or any other business to pay someone else to compete with them. It was clearly part of a larger plan to get rid of this operating agreement for exemption from antitrust [laws]."

Other critics believe that large newspapers, which are tied to huge printing presses and gas-guzzling delivery trucks, could become extinct, and that nimbler prototypes that deliver news by mobile phone and integrate social networking on their Web sites could assume the old media’s traditional role as public watchdogs.

Jeff Elder, who is studying the newspaper industry as a Knight fellow at Stanford University, told the Guardian, "You either see a daily newspaper as an old railroad station, a really cool part of the city’s history that you maybe can’t afford to save, or an at-risk public school whose continuance is fundamental to democracy."

Elder, a columnist for the Charlotte Observer, was one of a wide variety of media professionals (including Guardian publisher Bruce B. Brugmann), who gathered March 17 in the San Francisco Public Library to discuss the Chronicle‘s future.

"There is no minimizing that it’s a real sad situation for the people being laid off," Elder said. "But there is a real danger in propping up print products by strengthening monopolies. You’re draining off resources while propping up a business model that is becoming increasingly irrelevant."

The polluting Port

GREEN CITY Manuel Rivas is an independent truck driver working at and living near the Port of Oakland, where diesel exhaust from old idling vehicles has created a serious public health threat.

Officials have long talked about addressing the problem (see "ImPorting injustice," 7/17/07). In the meantime, however, Rivas and his twin boys — whom he has cared for alone since his wife died in a car accident 12 years ago — struggle with respiratory problems on low wages and with no health insurance.

"I’ve spent 21 years working as a truck driver. This is where I’ve spent most of my life, and I don’t have anything from it. You can see for yourself," Rivas tells the Guardian in Spanish, gesturing to his small, rundown house and showing us his empty refrigerator. "We are people, not slaves. We fuel the economy not just here in Oakland, but throughout the country."

Rivas works eight to 10 hours per day and says he takes home about $5.55 per hour after the expenses for his truck. Deregulation of the trucking industry has left drivers, many of them immigrants, as independent contractors with low wages and few benefits.

"We don’t get any vacation time," he said. "We don’t get health insurance. If we get sick, then we have to pay out of our own pockets."

And they do get sick. Diesel exhaust is a toxic air pollutant. The Coalition for Clean and Safe Ports organized an asthma screening in West Oakland last month to address problems around the Port. "Small particulates get breathed into the lower reaches of the lungs and cause irritation and inflammation, an increase in respiratory problems like asthma, chronic obstructive pulmonary disease, and a long term risk of lung cancer," said Dr. Robert Harrison, a UCSF professor who participated in the screenings.

Sandra Witt of the Alameda County Health Department said West Oakland residents are exposed to three times more diesel particulate matter than the rest of the Bay Area, thanks to the Port and nearby freeways.

"We’re driving all day, every day, and at this moment my throat is very dry and it hurts, so I take cough drops," Rivas said. He is concerned that one of his sons recently came down with bronchitis and was unable to play soccer.

Harrison says that children and the elderly are most susceptible to toxic air. "Bronchitis is one of the symptoms of respiratory problems from diesel pollution," Harrison said. One in five children in Oakland has asthma, the highest rate in California.

But treating a large population for respiratory problems is difficult. "There really isn’t any way to treat the community unless you reduce air pollution," Harrison said. "I found that the independent status of truck drivers keeps them vulnerable to health problems."

Port Commissioner Margaret Gordon, a longtime community activist before joining that body in 2007 (see "Port tack," 10/10/07), has pushed the Port to take responsibility for its contribution to the problem. "Diesel is bad in any way it comes. In trucks, trains, ships, cargo, or cabin equipment, it’s bad. But the closest thing to the people of West Oakland are the emissions from the trucks," Gordon said.

Swati Prakash of the Coalition for Clean and Safe Ports hopes that new legislation will alleviate some problems from diesel pollution. "For the first time you have state regulations coming down the pipe," Prakash told us. "The California Air Resources Board has recognized how deadly diesel pollution is."

On Jan. 1, 2010, pre-1994 trucks will not be allowed on Port land and 1994-2003 trucks must be retrofitted to reduce diesel particulate matter by 85 percent. But Rivas can’t afford a new truck, so he and other drivers are hoping to become employees of trucking companies.

The Port’s Comprehensive Truck Management Plan (CTMP), which will address diesel pollution and related issues, is now being drafted and is set to go before the commission for approval in June. Richard Sinkoff, the Port’s director of environmental programs and planning, said staff is working at an accelerated schedule because of the urgency of the issue.

"I think the board really understands that public health is a concern for all of us," Sinkoff said. "Time is always of the essence when dealing with a recognized public health issue."

I spent the weekend with my head under the kitchen sink, experiencing that loop of doom that makes old San Francisco houses so charming. The drain was stopped up, so I figured I’d pull the trap and clean it out, but the pipe broke in half the minute I tried to unscrew it. When I bought a new one, the pipe it attached to started to crumble, and when I replaced that one, the seals on the next pipe were shot, and after the third trip to Cole Hardware, I realized that I was going to have to pull out all of the kitchen plumbing and replace everything.

So I was lying there on my back, with dirty water and little pieces of whatever foul gunk had adhered to the insides of the old pipes dripping into my eyes, and all of the Sunday ads and advertorial sections of the Chronicle next to me to sop up the mess, and I started thinking about why I subscribe to The New York Times.

We’ve considered cutting it off — it costs a lot of money, and we’re trying not to spend a lot of money these days. Also, if I want to, I can find all the entire paper on the Web anyway. I don’t even get most of my world news from the Times; I read the British papers, the Guardian and The Independent.

But every morning while I’m sitting at the counter eating my breakfast, I turn to the Times op-ed page and get some of the most intelligent, interesting insight and commentary you’re going to find on a single sheet of paper anywhere in the world. And I thought: If the Times was in such dire financial straights that it had to fire half its staff, and Bob Herbert was one of the unfortunate souls chosen for a pink slip, I’d be joining the national uproar. There would be petitions, and editors’ inboxes would be jammed with e-mail, and marchers would mass in Times Square.

Ditto Paul Krugman, who is one of the few prominent economists in America who isn’t full of shit. And Thomas Freidman, who is sometimes full of shit but thinks so clearly and makes such cogent arguments that it’s a pleasure to get mad at him. And Nicholas Kristof, who routinely travels to some of the nastiest places on the planet to bring back the stories of how American policy affects human beings who otherwise would have remained in the shadows for life. That page alone is worth $1 a day; in fact, it’s one of the greatest bargains on Earth.

I don’t know whom the Chronicle is going to fire March 31 when the cutbacks are supposed to happen. I have kinda, sorta friends there, and there are some good, honest reporters, and I hope they all survive. But is there any political opinion columnist whose pending demise would get me out of my chair to a rally? Uh, no.

I love Jon Carroll, but he writes a lot about cats and mondegreens and there’s a good reason he isn’t on the op-ed page. Debra Saunders? Sorry, she’s an idiot. (And not just because I disagree with her — William Safire is one of my favorite writers ever. Saunders? Idiot.) C.W. Nevius? Belongs in the suburbs. John Diaz? Eh. Whatever.

I still pay for the Chron, but I’m not surprised that hardly anyone else I know does.

Madam Speaker, I Object!

Clint Reilly’s column ought to be the institutional line in every independent daily paper in the Bay Area and beyond.
However, since there are no independent dailies left and all the Bay Area and most of California dailies are owned by out-of-state newspaper chains, this is not to be. But at least his column appears in the MediaNews/Singleton papers in the Bay Area, thanks to the settlement of his last federal lawsuit challenging Hearst/Singleton collaboration.

Reilly opposes Rep. Nancy Pelosi’s move to gut the antitrust laws to accommodate more Hearst/Singleton collaboration. The Guardian goes a step further and recommends that Pelosi and U.S./ California/San Francisco politicians promote legislation and resolutions at federal, state, and local levels that would bar a daily newspaper in a one-paper town from closing down unless and until the owners offer it for sale at a fair price and give someone else a chance to run it.

And we recommend that, since any Hearst/Singleton collaboration would have national implications, this should happen only in a fishbowl in the glare of the mid-day sun. More: our federal, state, and local politicians should
pull out the stops: subpoena Hearst documents, hold public hearings in Washington and San Francisco, and promote any and all alternatives to another daily paper assassination. Save the Chronicle! B3

Sanctioning a Bay Area newspaper monopoly in order to rescue the San Francisco Chronicle from bankruptcy is a horrible idea.

Does anyone know what I’m talking about?

Last week, House Speaker Nancy Pelosi sent a letter to Attorney General Eric Holder urging him not to enforce antitrust laws, which would pave the way for the Chronicle and MediaNews – the owner of every other paid-subscription daily newspaper in the Bay Area – to merge operations and have a monopoly over news and opinion in the Bay Area.

The San Francisco Municipal Transportation Agency’s (SFMTA) today quelled fears that its $120 million budget deficit might kill or delay implementation of the long-awaited Bicycle Plan and its 56 near-term projects, which have been stalled by a three-year court injunction.

Timothy Papandreou, assistant deputy director of Transportation Planning and Development at the SFMTA, told the Board of Supervisors Land Use Committee that a new expanded bike network of paths, lanes, racks, and signage will likely get underway in July.

“July/August, we’ll physically start putting things on the street,” he said to a packed room of bicycle supporters, with neon green “Bike Plan Now!” stickers on their shirts and helmets, enthusiastically greeted the news.

The news from Rock Rapids: Shinny’s funeral

Shinny during his years as chief of police in Rock Rapids, Iowa, during the l950s. This was the card I had in my billfold when I heard about his death. He was technically “Shene” but he was Shinny to me. Shinny approved of my pronunciation. His last card omitted a key word from his earlier cards: “lover.”

The funeral services for Elmer (Shinny) Sheneberger, the central figure in the famous Halloween caper of 1951, were held Friday March 20 in the Congregational Church in Rock Rapids, Iowa.

I got word from Marj and retired CPA Jim Wells and Shinny’s nieces Audrey and Margo Wallace that Shinny had died on Saturday March 14 in his suburban mobile home in Phoenix, Arizona. He had fallen the day before and was found 20 hours later. He was terminally ill with cancer but hanging on.

Shinny was born and raised and lived his entire life of 92 years in this little northwest Iowa town. He was what every small town needed and cherished: an authentic good-natured character who went on generation after generation. He was somehow always there, when you needed him and sometimes when you didn’t. When a politician came to town, the word would get around that Shinny was briefing him at the Lane Cafe. When the Hermie Casjens gang rolled a loaded boxcar across Main Street, twice, on Halloween eve in 1951, Shinny was on duty as chief of police and had to move the boxcars off the street.

I never told Shinny who was involved in the incident and he never asked. Finally, years later, I gave him the full story. He laughed and said, “Let’s drink to it.” We did and did all through the years. When he would call me at my office in San Francisco, he would say, “I want to speak to Bruce. This is his parole officer in Rock Rapids.” Shinny had a wonderful way of operating on Halloween: he would just come upon the roving Casjens gang, and would just shine his car lights. We would scatter and he would move on, never making an arrest. In fact, I don’t think he ever made many arrests, that night or on any other Halloweens. His was humane law enforcement, Rock Rapids style.

Shinny did roll the boxcars back off of Main Street, but we never knew exactly how he did it. He explained in detail at our 55th class reunion last June in Rock Rapids. We invited Shinny to come after Dave Dietz and I got firm assurances that the statute of limitations had run and we were free to talk about the incident. We surmised that Shinny had gotten everyone out of a nearby dance at the Community Building to move the cars. No, he said, he rousted people out of the nearby movie theater under threat of “arrest” and pressed them into action, twice.

Shinny was quietly generous. He owned a farm near town and he told me that he was would be willing it to Camp Foster, the YMCA camp on nearby West Okiboji Lake where many of us went to summer camp. “I always thought highly of the boys who came out of that camp,” he told me. “And so I thought that would be a good place for my farm.”

Through the years, Shinny would say to me, “Bruce, you and I have got to get along together. We’re going to be together for a long, long time.” I never could figure out what he was talking about until I was out visiting the Brugmann plot at the Riverview Cemetery, the picture postcard cemetery atop a hill overlooking the Rock River. I noticed that the plot next to the Brugmann plot was the Sheneberger plot. As usual, Shinny was right.

Here is the email note I sent to my classmates on our email tree for the Dream Class of 1953 (16 boys, 16 girls, now many less):

Shinny’s funeral will be tomorrow (Friday) in the Congregational Church in Rock Rapids.

I ordered a bouquet of red tulips for the service from the Flower Village, with a note “from the Brugmann family and the Class of 1953.” I assume I don’t need to go over the details once again about Shinny’s connection to our class and his involuntary participation in our class activities and the famous Halloween incident of 1951.

Shinny was a longtime member of our church. He always wanted to live as long as Henry Rahlk, also a member of our church, who lived to be 102. Shinny, alas, only made it to 92.

I always enjoy buying my flowers from Flower Village, which once was in the old Brugmann’s Drugstore building. It’s now across the street in the old Bernstein department store building. Each year on Memorial Day, I phone in to Flower Village and buy potted flowers for all the members of the Brugmann plot at Riverside Cemetery. That’s both sets of my grandparents (Ethel and C. C. Brugmann, founder of Brugmann’s Drug in l902; and Allie and A.R. Rice, a Congregational minister in several small Iowa towns); my mother and father (Bonnie and Conrad Brugmann, who was a partner with my grandfather in the drugstore from the Depression onward); and my aunt and uncle (Mary and Clarence Schmidt, a veterinarian from Worthington who was the family representative in World War II.) I hope to end up in the Brugmann plot with my wife Jean.

And the Village people put the flowers on the plot, always well positioned and blooming nicely. Shinny’s family had the next plot and he would always take pictures of my potted flowers and send them to me with a friendly note about “staying in touch and getting together someday.”

And then I would always call the former Janice Olsen to remind her to pick up the flowers and take them to her home in Rock Rapids, once the home of her aunt and uncle, Edna and Harold Jongewaard. Harold was a funeral director in Rock Rapids for many years and buried almost all of our family in our plot. Janice’ s mother was Elsie Olsen, Clarence’s sister, and the Merl Olsens had a family farm out near Edna that I used to visit when I dated her in our junior year.

I didn’t mean to ramble on so long, but Shinny’s death reminds me once again of how it was and still seems to be back there in Rock Rapids, the best little hometown in the country. There are lots of good connections and lots of good memories, but they grow dimmer and dimmer.

Livin’ La Dolce Vita at Pizzanostra
Jocelyn Bulow of the Chez Papa and Chez Maman restaurant group and Italian chef, Giovanni Aginolfi (who was cooking pizzas in Nice, France, prior to coming to SF), join forces for a new pizzeria/osteria on Potrero Hill called Pizzanostra. Aginolfi placed sixth in the World Pizza Championship and now we can get ’em right here. There are two themes to this restaurant: a pizzeria serving Aginolfi’s famed pies, and an osteria with a menu of antipasti, foccacias, salumi, pastas, gelatos and Italian wines. Masa’s makes fine dining affordable
Masa’s is one of SF’s most revered fine dining destinations for more than 25 years, but set menus run $105 for six courses or $155 for nine courses per person. Will drug cartels buy the Chron?

Ink drizzles through my punctured veins. Indeed, the toxins that ooze from chemical inks and pulp during a lifetime of reading and writing for newspapers may well have contributed to the tumor that now weighs upon my liver.

Genetics predisposed me to such contamination. My dad was a founding member of the Newspaper Guild when he toiled with Hayward Broun at the old New York World-Telegram (later the World Telegram & Sun.) On December 7, 1941, a day that will live in infamy for more than one reason, George Ross, the WT’s drama critic, restaurant reviewer, Broadway columnist, and general lout-about-town, pushed my stroller into the Telly’s frantic newsroom in lower Manhattan and there, wedged between knobby-kneed reporters, I was introduced to the frenzy of a big-city paper at a maximum moment of world crisis. I was hooked for life.

Newspapers provoke liver cancer. It’s not just the ink and the pulp. Reporters are forever hunched over the bar at the dark dives that abut the rags where they slave, morosely drowning their resentment at editors who just eviscerated their big scoops, in an excess of cirrhosis-generating booze.

Here in San Francisco, working saloons like Hano’s and the M&M, where the newshounds once gathered, have been yuppified into oblivion in this suddenly one-newspaper town. I mourn them as deeply as I mourn my liver.

Although I was on staff at the Examiner (now free and “worth every penny of it”), I never spent much time pounding out my stories on the premises. I had an editor named Jack McCarthy, bless his soul, who insisted that the paper paid me to run away from the pack. The “Monarch of the Dailies” had just been handed over to Willie Hearst, Patty’s cousin, and I found myself a frequent contributor (ten front pages during the stolen 1988 Mexican election) along with Hunter S. Thompson and Zippy the Pinhead as the scion of Citizen Kane commited to going head to head with the Chron. This didn’t last long.

My M.O. at the Zam, much as it had been at the Bay Guardian and Pacific News Service was to ir al lugar de los hechos – to go to the place where it happens – rather than hanging around the phones doing dumb desk stories. I was always on the road. But whether they ran in the dailies (I was big in the Chron-Zam Sunday bulldog edition), Rolling Stone, Mother Jones, the Northcoast Environmental Center Econews or the National Horseshoe Pitching Journal, my reportage always appeared in print. Your thumb got inked with the words I wrote.

Now I’m reduced to bloodless ciphers streaming across Internet pages. Counterpunch serves a function but it hardly satisfies my craving for real live chemical inks and pulp.

By a synchronistic twist of fate, newspapering in the U.S. is dying as fast as my liver. Pretty soon they both will be heirlooms, yellowing ancient slabs like the binders of Mexican newspapers at my corner library in the Centro Historico of Mexico City, El Gran Monstruo, to which my neighbors return time and time again to revisit the heartbreaks of the past.

CJR slams the Chronicle

The Columbia Journalism Review trashed the Chronicle this week, in a harsh, pointed and entirely on-target piece by Pulitzer Prize winning reporter David Cay Johnston.

Johnston’s chief complaint: The Chronicle has done a miserable job of reporting on its own possible demise. In sharp contrast, he says, the Seattle P-I ran some well-reported stories about the papers’s closing that let readers know what was actually going on.

The blog post raises some interesting journalistic questions, though, that are going to be echoing through this entire debate about the future of newspapers.

The first thing I noticed when I read Johnston’s piece was that he singled out the Chron’s editor, Ward Bushee:

under editor Ward Bushee the Chronicle has provided little actual news reporting about its prospects for dissolution unless its unions agree to drastic job cuts and givebacks for those who remain on the payroll.* Mostly, Bushee gave Chronicle readers unsigned “staff reports”—actually rewritten Hearst press releases.

He later attacks Phil Bronstein, the former Chron editor who is still a top Hearst executive:

At least the careful reader found out that Phil Bronstein, the journalist who is now editor-at-large, has abandoned that role to become an unregistered lobbyist seeking political favors for his employers.

Johnston is a careful, weidely respected reporter who does his homework. And in this case, his analysis of the situation seems entirely accurate. The Chron hasn’t been giving us the real story of what’s going on — and the stuff left off the news pages is really interesting.

But I was surprised that neither Bushee nor Bronstein were quoted in the piece; I’ve always thought that before you attack someone in print (or online) — particularly when you call into question their professionalism or ethics — you should call first to get that person’s response. It’s not only common courtesy and standard journalistic practice; it makes for a better story.

So I emailed both Bushee and Bronstein, and both confirmed that Johnston had never contacted them. Bushee:

I will not comment about the Chronicle’s situation during the union negotiation period. I’ve told this to every reporter who has called to ask.
I have never been asked for comment by the (sic) David Cay Johnson. I was called by him one evening several weeks ago to tell me to look up another story on CJR.com — and then he promptly hung up.
In his latest posting on CJR, he continues to get my name wrong (my father, who has been dead for seven years, was Ward Bushee Jr.). But that is only the start of his errors.

Bronstein:

I’m not going to debate someone who has no real information and hasn’t tried to get any.

In general, we all ought to be talking about the value newsrooms and journalists bring to society – as Bruce Bruggman (sic) did very articulately the other night – to anyone who is willing to listen.

As columnist J.R. Labbe wrote in the Fort Worth Star-Telegram about that paper, “This newspaper gave more ink to the campaign to save the Texas Ballet Theater than it has to making this case for its own future. Time for that to change.”

Okay, fair enough. But here’s where it gets interesting.

I called Johnston to discuss all of this, and he was happy to talk to me. “This was a blog,” he said. “If I were writing a story for the New York Times, I would have absolutely called them.”

Why is a blog at CJR any different from a newspaper story? Johnston:

“I’m the definintion of a dinosaur, but I’m trying to embrace the idea that this is a new era. This is an experiment for me. I’m trying to see what happens when we embrace the values of the blog world. What if we just write what we see? I’ll take some slings and arrows, but I’m trying it out.”

He promised to correct the error on Bushee’s name, and did.

David Cay Johnston has done some phenomenal work He’s a perfect example of the value of a major newspaper — the New York Times had the money to pay him to spend weeks and months digging into the federal tax code so he could tell the world how government policies were helping the rich screw the poor. We’d all be a lot less informed without him.

But I have to say, with all due respect to one of the great reporters of our time, I don’t think a blog for CJR is any different than a story in the Times. The world of journalism is changing, and in a few years, none of us will be putting stories on dead trees any more — but the delivery vehicle isn’t the issue. There will be millions of bloggers who comment on things, which is a positive development and I love it, but there will also have to be real news institutions that pay staff people to report stories. And those reporters still have an obligation to call the objects of their attacks and scorn and get a response.

The future isn’t going to be about newspapers vs. online publications. It’s gong to be about journalists doing one kind of job, and others using the web to do something different. Not bad, not wrong — just different.

Drinking in the dark

I was reminded of this (potentially racist, but I’m part Irish, so screw it) joke yesterday during a two-hour conversation about the Chronicle that took place, mostly between media people, in the basement of the library, on St Patrick’s Day.

The fact that any reporters showed up to talk about journalism on St Paddy’s Day is a good indicator of just how troubled they are feeling about the state of the news industry.

Normally, reporters would be writing about folks drinking too many Irish car bombs, or, if they weren’t working that night, drinking too many green beers themselves.

Instead, they sat and talked about the challenges facing San Francisco’s main daily newspaper, and the future of journalism in the Internet age.

Now, you’d think this would be easy for a bunch of folks who are used to digging into other people’s business and publishing what they find out, including the for-profit-driven doings of this or that evil corporation.

Only this time, the folks being bullied are the workers at the San Francisco Chronicle, which is owned by Hearst. a privately held corporation. This means the Chronicle won’t be publishing the findings of its own journalists’ findings on this matter. Instead, it’s been running reports that have no bylines and sound like Hearst press releases.

And then there’s the disquieting reality that Hearst has refused to open its books to the unions that represent the workers at the Chronicle. This means that all Hearst’s claims, including the statement that the Chronicle is losing $50 million a year, remain just that: claims, until proven otherwise.

No one is disputing the fact that newspapers have been losing advertising revenue to the Internet. Or that few of us have figured out ways to recapture that revenue. Or that many of us have been laid off, suffered pay cuts and/or seen an end to our careers, even as more people read our stuff than ever.

So, are we going to drink in the dark, or shine some light on the situation?

Personally, I don’t want the Chronicle to die. I want it to improve. And, as an investigative reporter, I want proof that Hearst’s financial claims are real.

Long time Chronicle reporter Carl Hall, the local representative of the California Media Workers Guild, confirmed last night that Hearst refused the Guild’s requests to open its books.

Hall also confirmed that Guild members voted to accept the loss of 150 jobs and the elimination of seniority rather than risking calling Hearst’s bluff over the corporation’s threats to close or sell the Chronicle.

Of course the workers did. They’re newspaper men and women. Like doctors and teachers, they love their jobs, no matter who is running the hospital, school or newspaper.

But I wonder if the rest of the media have fallen down on the job, by not challenging Hearst’s unsubstantiated claims, even as the entire nation is discovering that it has been Ponzi-schemed up the kazoo.

I was heartened to hear Chronicle forum panelist and social entrepreneur Tom Murphy point out that some of the industry’s current problems are related to the newspaper-buying binges that Hearst Corp. and Dean Singleton’s MediaNews indulged in during the past decade.

And it was interesting to hear Oakland Tribune editor Martin Reynolds, which itself got swallowed up by Singleton in recent years, admit that many newspapers chains are in a similar situation to the owners of foreclosed homes: “They are upside down on their mortgages, right now,” Reynolds said.

Connect those financial dots to the fact that readership of the Chronicle is growing online, and you begin to realize that there is a way forward through all this, even if we haven’t figured it all out yet.

As Center for Investigative Reporting cofounder and forum panelist David Weir put it last night, ‘Don’t blame the Internet for journalism’s demise. The Internet is not a choice, it is a fact. It is a technical and historical reality.”

Kennedy, compounded

HYPOTHETICALLY SPEAKING It’s chaos theory’s maxim that the mere brush of a butterfly’s wings might produce a ripple effect sufficient to changes history. But let’s face it: it’s more interesting to muse upon the big what-ifs, like assassination attempts. What if Lincoln or Archduke Ferdinand had survived? What if Reagan hadn’t?

Are such speculations actually useful, or just a glorified party game? Clearly Koji Masutani thinks it’s the former, since he’s gone to the trouble of making Virtual JFK: Vietnam If Kennedy Had Lived. As presented by the director and foreign policy historian James G. Blight, this new documentary makes the case that Kennedy’s nonconfrontational tactics on the world stage during his presidency would surely have carried over to preventing that "quagmire" known here as the Vietnam War (and over there as "the American War"). Had he lived, of course.

Parallels to our moment are hard to resist. Like Obama, JFK’s election was viewed as a landmark and greeted with messianic excitement unequalled by a Democrat until now. He arrived at a time of equally daunting if very different emergencies — the Cold War’s peak boiling point, the civil rights movement heating up at home — and likewise faced hostile Republican lawmakers as well as skeptical press.

Masutani charts six occasions on which JFK dodged armed conflict that might have triggered (or so reasoning went) World War III. The Cuban Missile Crisis is the obvious one. Others, all four-alarm calls for anti-commie action, include resisting engagement in Laos and Vietnam, as well as over the Berlin Wall’s construction. In archival footage Kennedy looks alternately uncomfortable and good-humored defending his policies, as he’s accused of "appeasement toward communism," "utter incompetence," and "mismanaging the news" by rationing his statements to prevent hysteria outbreaks in an already paranoid nation. "This generation of Americans has already seen enough war and hate," he pronounced. Amen.

Alas, that fateful open-car ride in Dallas placed Lyndon B. Johnson in office. Though it evidently tormented him, LBJ saw no alternative to an ever-expanding Vietnam incursion. Some 58,000 U.S. lives and 2 million native ones later, it remains the quagmire by which all our blunders abroad are measured.

These days, not everyone thinks Kennedy was as golden as that Camelot glow suggested. But Virtual JFK does convince us that things would have turned out quite differently, at the very least, had he missed taking a premature powder. May history not repeat itself.

Spicy Bite

We all have our little weaknesses, and one of mine is any form of the word "spice." "Spicy" is a particularly potent variation, since in common usage it doesn’t mean well-spiced in a general sense, with nutmeg and clove — like carrot cake or mulled cider — but flavorfully hot. If some dish is described as spicy, whether shrimp or French fries, I am going to have a hard time staying away from it. And if a restaurant has the word "spicy" in its name, I am going to have a hard time staying away from it, too. I am all ears. Or eyes. Or nostrils.

Despite this strong sensory awareness, I don’t know of many restaurants in the city that answer to this alluring description. There is Spices! on Eighth Avenue near Clement, a kind of hipster noodle house serving a pan-Asian menu with plenty of kick. Google also reports the reality of Thai Spice on Polk; this is news to me. But let’s not forget Spicy Bite, an Indian restaurant at the southern edge of the impressive restaurant row that has developed in recent years near the confluence of Mission and Valencia streets.

An Indian restaurant in these environs is welcome for its very Indianness. The neighbors include a wealth of Mexican and other Latin American restaurants, a smattering of Thai and Chinese places, the impressive Blue Plate (with high-grade new American cooking), and the endearingly quirky Emmy’s Spaghetti Shack, a kind of alt answer to Pasta Pomodoro. So Indian, yes, good; spicy Indian, better!

"Spicy bite" could mean any kind of spicy bite, but your nose knows what awaits even before you step inside. The smell of curry drifts through the front door and hovers at the corner as a fragrant cloud and an advertisement. Few food establishments can match the olfactory signature of Indian restaurants — only bakeries and breweries, in my experience. Spicy Bite offers both beer and wine, but because south Asian cuisine didn’t evolve in the company of wine, I tend to find matching the two awkward and to prefer beer instead. (Beer is underrated as an accompaniment to food; it might not be as good as the best food-wine matches, but in my experience it pairs up with a wider variety of foods than does wine, while clashing with none. Certainly it goes well with spicy foods of every description. Almost no wine can make that claim.)

Given the centrality of India to vegetarianism, it’s not surprising to find that Spicy Bite is vegetarian-friendly in addition to being spice-hound friendly. You can do very nicely here without touching flesh, from lovely pappadum ($2) — the crinkly lentil wafers, with their faint sheen of frying oil, like freshly painted object rapidly drying — to a meatless biryani and a long list of what the menu calls "vegetarian dishes." These are none the worse for being familiar and include a richer-than-usual saag paneer ($9.50) with an abundance of cubed white cheese, and a fine chana masala ($8.50), with chickpeas in a velvety sauce softened by tomato. One also suspects butter as a player in many of these complex sauces — not an issue for most people, but possibly worth asking about for those who shun dairy.

Chili heat varies per your request, and there are three settings, as on an inexpensive blender. I like hot and spicy food, but one person’s hot is another’s incendiary and inedible, and asking the server for guidance usually produces a philosophical shrug. We ended up on the "medium" setting and found the dishes so seasoned to be plenty hot enough.

As for flesh: the tandoori chicken ($8.50) surprisingly disappointed. The half-bird was tasty and tender enough; it was an attractive rosy color and arrived on the customary hot iron skillet, complete with lemon quarters, tomato chunks, and sizzling shards of onion. But the meat turned out to be a little dry, despite what must have been an hours-long, or overnight, bath in a yogurt marinade.

Shrimp tikka masala ($12.50) were juicier — a set of nice, fat peeled prawns, roasted in the clay oven in a tomato-cream sauce. Purists often insist on cooking shrimp in their shells, I guess for flavor and moisture retention, but it’s certainly more end-user-friendly to shell them beforehand. Judging by the Spicy Bite example, it is indeed possible to cook shelled shrimp successfully without drying them out and ruining them.

No Indian meal is complete without either a side of basmati rice (cooked here with saffron, $2), or a round or two of naan, or — if you’re a starch fiend — both. The rice grains didn’t stick together (nice), while the bread was served already cut into triangles, like pita, which did slightly dim one’s Neanderthal pleasure in ripping out pieces as needed but was, on the other hand, much more convenient.

Take-out traffic can be heavy, with deliverers coming and going (free delivery is available in some areas until 10 p.m.). But while service often stalls at a restaurant that does a sizable take-out business, this isn’t the case at Spicy Bite. The wait staff is attentive and professional, the kitchen turns things out promptly, and the space itself — a corner box not unlike Emmy’s — has a certain presence. But if you want carrot cake for dessert, forget it. There’s kheer, kulfi, and a pastry made from milk and honey, each three bucks.

GREEN CITY The Transbay Terminal rebuild is moving forward, but this multi-modal downtown transportation station seems to be pulling away from what was supposed to be its showcase centerpiece — the California High-Speed Rail Project — before it can satisfy the design and capacity needs rail officials require.

San Francisco officials from Mayor Gavin Newsom to Sup. Chris Daly, who sits on the Transbay Joint Powers Authority (TJPA) Board of Directors, all say high-speed rail must be a component of the Transbay Terminal. Yet they were caught off-guard when the California High-Speed Rail Authority (CHSRA) recently made clear that the station would need to handle up to 12 trains per hour, more than double what current station designs can accommodate.

Even as phase one of the station got underway in December (see "Breaking ground," 12/10/2008), it lacked the more than $300 million needed for a so-called train box that would make it easier and cheaper to later bring high-speed rail and Caltrain into what would otherwise be a $4.3 billion bus station and commercial complex.

TJPA officials were struggling with how to secure that money, ideally through federal stimulus funds, when officials from CHSRA and Caltrain told a Feb. 25 Metropolitan Transportation Commission meeting that current designs were inadequate for their needs (see "Stimuutf8g transit, 3/4/09).

While the demand for straight platforms, rather than the curved ones TJPA designed, can be fairly easily addressed, the volume issue is far more significant and costly. During a March 12 TJPA meeting on the issue, engineers said that adding the third floor of trains that would be needed to handle 12 trains per hour would add $1 billion to the cost. Even if no train box is built, TJPA officials say that just the foundation work and deeper dig needed for the higher capacity would add $500–$700 million to the cost of the project’s first phase.

The good news is the federal stimulus package sets aside $8 billion for high-speed rail development, and Transbay Terminal is one of the few shovel-ready projects out there that would qualify for immediate assistance. The bad news is the criteria for attaining those funds won’t be ready by the time TJPA plans to sign its construction contracts in late May.

Delaying the project would not only increase costs and forestall the immediate economic stimulus impacts of the construction, it would also anger bus transit agencies such as AC Transit, which kicked in $57 million to the project. "AC Transit expects the TJPA to meet its commitment to AC Transit and its passengers, as well as keep the construction of phase one on schedule," AC Transit attorney Kenneth C. Scheidig wrote to TJPA March 11.

At the March 12 meeting, TJPA members uniformly reacted with dismay to their dilemma, criticizing CHSRA for its unrealistic demands. Program manager Emilio Cruz said the agency had designed to high-speed rail specifications and only learned in January of the desire for trains to run up to every five minutes during peak hours.

"They were presented without adequate justification for why they need increased frequency," Cruz told the TJPA board as he offered his analysis for why that frequency isn’t needed to handle the 12 million annual riders the system predicts for 2030 and noting that Tokyo — which has far greater volume and density — is the only high-speed rail station in the world to run 12 trains per hour.

CHRSA executive director Mehdi Morshed said Cruz isn’t a rail expert and disputed his analysis, noting that Tokyo and Paris each have multiple stations that together run far more than 12 trains per hour. He also noted that the BART system is at capacity after just 30 years.

"We are building a train that has the capacity to hold not just the riders in 2030, but beyond that," he said. "They are trying to fit the high-speed trains of the future in a very limited space, and we’re telling them that’s not adequate."

Morshed said his agency is still years away from getting into station design, but has been as accommodating as possible with TJPA’s desire to move forward now. Daly and others have pointedly criticized CHSRA and its chair, Quentin Kopp, to which Morshed said, "Sure, we can take all the blame, but how is that going to help San Francisco get its station?"
