Well, I’m really sorry I missed the Democratic Party gala Wednesday night. Apparently it was quite a show. Brian Leubitz has a great report at Calitics on the unexpected appearance of Gov. Schwarzenegger and the overwhelmingly negative response by the attendees, including Assemblymember Tom Ammiano, who stood up and shouted “You Lie!”

“It was political theater of the type we love,” Ammiano told me.

Seriously, though: Former Mayor Willie Brown apparently told the guv that the event was happening, and since Schwarzenegger was in the same hotel for a President’s Cup event, he decided (perhaps at Brown’s invitation, it’s not entirely clear) just to drop by. And everyone was supposed to act all nice and pretend that they’re aren’t real, serious issues in Sacramento and that the governor isn’t really, really screwing up the state and hurting a lot of people.

“This wasn’t the Legislative Chambers, where you have to put up with this shit,” Ammiano said.. “It’s like this guy just showed up and took a big dump in my living room.”

Labor folks weren’t happy, either, and a bunch of them walked out. Then Ammiano (and we should all give thanks that he’s in the Legislature, reminding everyone what San Francisco stands for) accepted an award and made a speech:

And then he proceeded to bludgeon the Governor’s record. He questioned why he was holding bills hostage to get a bad water deal. He questioned why a Governor who has vetoed the Harvey Milk Day bill would stand up in front of a room that was at least 25% LGBT. He politely asked Mayor Brown to send a message to the governor to sign the bills already.

And finally, Senator Mark Leno closed the proceedings for the evening. Leno took a different tack than Ammiano’s passion. He simply stated the facts. He said that the events of this evening were all funny and stuff, but the fact is that this Governor had cut state workers salaries by 15% with the furloughs. This Governor wanted to cut IHSS salaries to minimum wage. This Governor illegally used the line item veto to slash funding for domestic violence shelters. And that he, and the Senate Democrats, were going to fight him tooth and nail.

And to a loud applause, Leno stepped off the stage and the crowd began to thin. And everybody was saying, “um, wow.”

The other thing Ammiano said in his speech was that Democrats have gotten a little lax on standing up for their friends — and he mentioned both ACORN and Kim-Shree Maufas, and both times was met with huge applause.

And, of course, the Chron’s Carla Marinucci focused her reporton Willie Brown’s comments about how inappropriate this all was and how everyone needed to make nice to poor Arnold. But there are serious issue here that aren’t just fun and games, and when the stakes are as high as they are here, I’m glad to see them Democrats (or at least some of them) deciding not to play so nice with a governor who is smiling while he drives the state into bankruptcy and despair.

PS: Ammiano told me that when Marinucci called him, she seems astounded that he had said “kiss my gay ass” while walking out of the governor’s speech. “I told her, I don’t remember, but I probably did say that,” Ammiano said. “After all, it’s safe sex.”

Canadian cinemania: one critic’s take on TIFF ’09

There were quite a number of exciting films at the 34th annual Toronto International Film Festival, though attending 21 features and 20 shorts in five days also involved some disappointments. Japanese director Hirokazu Kore-eda’s Air Doll somehow dropped the ball in every which way, throwing around interesting concepts involving a sex doll who comes to life (a la The Velveteen Rabbit), but it ended up leaving me longing for Michael Gottlieb’s 1987 politically incorrect gem, Mannequin. Or Fridrik Thor Fridriksson‘s The Sunshine Boy, an Icelandic documentary about Autism around the world. Though it used Bjork and Sigur Ros on the soundtrack, it felt like an infomercial for public access. (To be fair, I saw the version with an Icelandic narrator and not the newest version with Kate Winslet reading the cues.)

Some films succeeded in minor ways, including George Romero’s fifth entry in his zombie oeuvre, Survival of the Dead. While enjoyable, this one seems to lack the political immediacy of his previous entries, including his underrated Diary of the Dead (2007). Michael Moore’s (last?) feature Capitalism: A Love Story had some brilliantly ironic moments — as always, interspersed with his typical forehead-slapping activism (do you really have to continue using minimum wage-earning security guards at major corporations as the butt of your wacky antic jokes?). It felt a bit scatterbrained. Still, the film is well worth watching and even won the runner-up audience award for Best Documentary.

The creator of the original British version of The Office had his directorial debut with The Invention of Lying. Ricky Gervais’ cynically hilarious, cameo-packed laugh-fest sadly ran out of steam during its last act, but no matter. What’s most important here is the sucker-punch moment that has Gervais flexing dramatic skills so poignantly that it literally brought tears to the entire audience. (On a side note, why doesn’t Gervais ever end up kissing his leading ladies? Is this a conscious choice to counteract the likes of Woody Allen or Vincent Gallo or is it truly due to a low-self esteem?)

Todd Solondz’s Life During Wartime, Bong Joon-ho’s Mother, and Claire Denis’ White Materials all delivered solid entries, proving these directors know their craft and do it quite well — though depending on how much you may have enjoyed their previous films you may be left wanting a little less or a little more.

Peskin takes on BART

BART’s a system close to meltdown, with a strike possibly looming, a police scandal still lingering and now the San Francisco Airport furious about a surcharge that’s forcing SFO employees to take a shuttle bus into work from Millbrae.

It’s also a political opportunity for somebody to run against James Fang, the last remaining Republican in San Francisco elected office, a BART Board member since 1990, an opponent of effective police oversight and reform — and a big supporter of the BART airport surcharge.

Aaron Peskin, chair of the Democratic County Central Committee, has introduced a resolution blasting BART for the surcharge and blaming it in part on Fang:

Whereas; BART Director James Fang, San Francisco’s only elected Republican, proposed and championed the surcharge as a revenue stream for BART. A BART Director, not subject to term limits, has represented San Francisco since 1990, and is the only San Francisco BART Director not to call for the resignation of General Manager, Dorothy Dugger in wake of the mishandling of the Oscar Grant BART Police shooting on January 1, 2009;

It calls for an end to the surcharge for airport employees — and take a bit of a swipe at a certain local elected board member:

San Francisco Democratic Central Committee supports the Airport in demanding BART reverse the inequitable and punitive surcharge at San Francisco International Airport. The SFDCCC asks San Francisco BART Directors, elected to serve, to lead the way in waiving the punitive fee hurting many minimum wage workers and their families and reexamining the financial relationship with SFO, as BART to the Airport continues to grow in ridership and popularity.

And it suggests that the campaign to elect someone other than Fang in 2010 is well underway. Can you say BART Director Aaron Peskin?

Shop local, City Hall!

On Dec. 3, 2008, just before noon, Mayor Gavin Newsom arrived at a press conference in Noe Valley to remind city residents why it’s important to shop locally. The mayor climbed out of his shiny new hybrid SUV, walked into the Ark Toy Company, showed charts and graphs, and talked about how money spent in town helps the local economy. Joined by Steve Falk, president of the San Francisco Chamber of Commerce, Newsom urged holiday shoppers to look first in San Francisco before buying something on the Internet or in some suburban mall.

The mayor’s shop-local press conference was a clear sign that the debate over the role of small business in the San Francisco economy is over. Everyone from the mayor’s business advisors to the Chamber of Commerce to small business advocates and progressive economists now agrees that small local businesses provide the vast majority of the jobs, keep their money in town, and generate more tax dollars, more wealth, and more prosperity for this city than the big out-of-town chains.

It was a picture-perfect scene, until KPIX-TV reporter Hank Plante asked the mayor an embarrassing question: Why, he wanted to know, did the Mayor’s Office buy Newsom’s new car in Colma?

Newsom said he didn’t have a clue.

Actually, the reason was pretty simple: the dealership in Colma submitted the lowest bid. But San Francisco lost out on the sales tax, a local Chevy dealer that was going out of business lost a local sale, San Francisco workers lost a commission — and in the end, the city almost certainly lost more on the deal than it saved with the Colma discount.

That’s the untold story behind the mayor’s promotion. San Francisco, as a buyer of goods and services worth hundreds of millions of dollars a year, does a terrible job at shopping local. Indeed, for years small business advocates have been trying to get city officials to make it easier for local merchants to get city contracts — and they’ve made very little progress.

"I’ve worked so hard on this, year after year, and nothing ever happens," Scott Hauge, a small business activist and organizer, told us. "After a while, I just threw in the towel."

Hauge is devoting his energy these days to statewide issues. But on the local level, there’s a growing sense that the city needs to do more to help small local businesses get their share of the massive public spending pie.

"The Small Business Commission has made it clear that this will be a priority over the next year," Regina Dick-Endrizzi, the commission’s acting director, told us.

Nobody knows exactly what percentage of city contracts for goods and services go to local businesses. Hauge said the Mayor’s Office did a limited survey about a year ago, but the data wasn’t very good. And while Newsom signed an executive order in 2005 directing departments to look for ways to patronize local businesses, there’s not much to show for it.

"I think probably less than 10 percent [of city spending] goes to local businesses," Hauge said.

Board of Supervisors President David Chiu, a former small business commissioner, agrees. "I think it’s accurate to say that at least 70 to 90 percent of all city contracts go to out-of-town businesses," he told us.

As Dick-Endrizzi pointed out, city purchasing has strict rules — and for good reason. "In most cases, you have to put out a request for proposals and take the lowest bid," she said. "If you didn’t have that, you’d have a big problem with favoritism."

But when the lowest bid is the only criterion, San Francisco businesses are at a distinct disadvantage.

"Say a city agency wants to buy five hammers," said Steven Cornell, owner of Brownie’s Hardware. "I have the hammers for $6, but somebody in Nowhere, Miss., can sell them for $5.99.

"Well, the shop in Mississippi doesn’t have to pay San Francisco’s minimum wage, doesn’t have to pay for sick days, doesn’t have to pay for health care … We’ve asked businesses to contribute to all these good social policies, then those businesses get penalized because someone else can sell something cheaper."

Cornell — who says he agrees that local businesses should pay well and give their workers benefits — is frustrated that when it comes to purchasing, the city doesn’t give anything back. "We lost S&C Ford, we lost Ellis Brooks Chevrolet," he said. "Those were all union jobs, with good benefits. And how many cars did the city buy from them?"

When Cornell was on the Small Business Commission, he remembered some small locally owned cabinet-making shops came to complain about a $4 million city contract for woodwork. "They told us that they lost the contract to a Canadian firm," he said. "The costs of operating in San Francisco were higher than in Canada, so they couldn’t compete."

"We do not as a city reflect the fact that we ask employers to do good things for their workers," Chiu added. "When we spend perhaps $1 billion a year in city contracts, those employers don’t have a level playing field."

Sure, on the surface and in the short term, the city gets a better deal when it awards contracts based entirely on price. But San Francisco has, as a matter of public policy, already decided there are good reasons to give minority-owned contractors some advantage in bidding, and that public contractors should pay prevailing union wages and offer benefits to domestic partners. Local enterprises get a modest advantage in some bids, but nowhere near enough to make up for the cost difference of operating in San Francisco.

And as Newsom himself has made clear, spending money locally has a long-term economic benefit that almost certainly outweighs the price differential in most bids. "When Newsom bought his car in Colma, the city lost the sales taxes, and lost the multiplier effect of the money being spent in town," Cornell noted.

In fact, a 2007 study by Civic Economics, sponsored by the San Francisco Locally Owned Merchants Alliance, showed that if city residents shifted just 10 percent of their purchasing from national chains to locally-owned businesses, the city would gain 1,300 new jobs and $200 million in economic activity every year.

Imagine the activity — the positive benefits to the local economy — that would come with the city shifting, say, 25 percent of its spending to local businesses.

Obviously the city can’t buy everything in town. "Nobody in San Francisco makes Muni trains," Cornell noted. But a lot of what city departments buy, from hammers and paper to cars and trucks, is available from local suppliers — or could be. "If the city made it known it was looking to buy something locally, some entrepreneur would come along and figure out a way to supply it," Cornell said.

So how could this work on a policy level? It’s not that complicated. The city controller, or the Human Rights Commission, which oversees contracting policy, could devise a formula showing how much the cost of complying with city laws like the minimum wage, health care, and sick days (laws that most of us, and many small businesses, fully support) drives up the cost of doing business in San Francisco. Then give local merchants an equivalent advantage in the bidding process.

In other words, if the hammers at Brownie’s Hardware cost 25 cents more than the hammers in Nowhere, Miss., because Cornell pays for his workers’ health insurance, he should only have to come within 25 cents of the cut-rate suppliers’ price to get the city’s business. And if the taxpayers have to fork over a few cents more to buy local hammers, the money will come back, and more, from the demonstrated benefits of shopping locally.

Chiu thinks that’s a good idea, and he’s already taken the first steps to forcing the city to shop local. Chiu introduced legislation in April requiring the city to set aside a portion of all contracts for locally-wned businesses and to increase the financial advantage local firms get in bidding.

And at Chiu’s request, the HRC will appear before the supervisors Land Use Committee May 11 to present the latest data on how much city spending goes to local businesses. "I’ve been asking for this for two years," Chiu said.

"It is unwise for our city not to take $1 of public money and give it to a local business that will pass that dollar onto its local employee, who will then spend it at another local business," he added. "The multiplier effect of this is that money spent locally is better for the economy, and for the taxpayers."

REVIEW The minimum wage that Albuquerque single mom Rose (Amy Adams) earns as a housecleaner isn’t enough to pay for the private school her eight-year-old son needs after his weird behavior exhausts the public one’s resources. And aimless-party-girl younger sis Norah (Emily Blunt) just got fired from her own last crap job. Cop Mac (Steve Zahn), the former high school sweetheart who chose to marry someone else but is still having an affair with Rose, tells her there’s real money to be made in the unpleasant business of "crime scene and trauma cleanup" — in other words, scouring the mess left over after the body has been removed from a murder, suicide, or natural death site. This agreeably low-key tale from director Christine Jeffs and scenarist Megan Holley isn’t the black comedy you might expect, given that plot hook: in fact one nice thing about it is that it doesn’t turn the aftermath of sad or tragic events into a joke. Instead, the emphasis is on sister dynamics and trying to get a break in the ever-expanding, hanging-by-a-thread sector of the working class. There’s nothing wildly original here, but Sunshine satisfies in the pleasantly familiar but not-dumb mode of 2007’s Waitress. Good supporting performances include those by Alan Arkin as (yet another) eccentric grampa, and Clifton Collins Jr. as a very personable one-armed cleaning supplies store clerk.

BUTTHOLE SURFERS


One of the best parts of reading Michael Azerrad’s Our Band Could Be Your Life (Little, Brown, 2001) is learning how psychotic the Butthole Surfers actually were. Whether filling an upside-down cymbal with lighter fluid and igniting and playing it or projecting scary-ass surgery footage onto huge smoke machine-generated clouds to terrorize the audience, the Buttholes clearly intended to have everyone walk away from shows with physical or mental wounds congruent to their own self-inflicted ones. By the time Electric Larryland (Capitol, 1996) gave them access to post-Nevermind commercial radio, the Butthole Surfers had transformed into a run-of-the-mill heavy rock unit, saving their perverseness for their lyrics.

But all’s you need to do is backtrack to Locust Abortion Technician (Touch and Go, 1987) to find the group’s secret reverence for classic rock juxtaposed with a not-so-secret love of tripping balls on tracks like the genuinely disturbing "22 Going on 23" and imagine that there was a time when the Butthole Surfers toured with a naked dancer named Ta-Da the Shit Lady but managed to devote enough energy to the whole "music" side of being a band to write something as enduring as the proto-grunge of "Human Cannonball." The group’s more recent output isn’t good, and it goes without saying that the ‘Urfers will never be able to equal the antics of their past. This one is a mixed bag, but I’m guessing that, while Gibby Haynes won’t be regaling us with tales of Chinese men with worms in their urethras, he won’t pull any cutesy "you are loved" Flaming Lips bullshit, either. GEORGE CLINTON AND PARLIAMENT FUNKADELIC


"Bow-wow-wow-yippee-yo-yippee-yeh." That was the "Atomic Dog" mantra back in the day when I worked at a mega-music store for minimum wage: it kept us tame, it soothed our frayed nerves, and it never failed to remind all concerned that there was a little dog in me, you, and everybody. Hell, if "Atomic Dog" mastermind George Clinton stopped with just Funkadelic’s Free Your Mind … and Your Ass Will Follow and Maggot Brain (both Westbound, 1970, 1971) many a fan boy and babe would have been satisfied to sing his praises forever more, but nooo, the musical groundbreaker and funk-rock-R&B OG of a dogfather has had more creative lives than a nuclear feline — a good and bad thing, I suppose, in terms of quality control.

Later, I would come to associate Clinton with a tale divulged by a colleague who was once allowed into the icon’s smokin’ sanctum sanctorum — namely a venue bathroom — to, ah, do an interview. This time, however, when the man brings Parliament-Funkadelic to the Warfield for New Year’s Eve, I’ll expect candidate Clinton — settling into his golden years, it appears, with the recent release of his covers album, George Clinton and His Gangsters of Love (Shanachie) — to tear the roof off with a super-stupid rendition of his prescient par-tay anthem "Paint the White House Black." FANTÔMAS


For all those who don’t want to spend their New Year’s Eves puttin’ the lime in the coconut and twistin’ it all up, General Patton has got you covered. Patton and the melodicidal miscreants of avant-garde metal quartet Fantômas invade the Great American Music Hall on a mission to decimate eardrums and bring aural beasts to life. The San Francisco supergroup — which includes Buzz Osborne of the Melvins, Trevor Dunn, formerly of Mr. Bungle, and Dave Lomabardo of Slayer — formed in 1988, and is Patton’s longest-running project. The resume of the king of musical ADHD reads like an major-indie label discography, but the workaholic always finds time to confound and bludgeon with Fantômas.

The group’s beauty lies in its ravenous experimentation and intensity — and in Osborne’s Don King hair. Over the course of their four LPs, they’ve mix electronic glitches; nonsensical and horrifying utterings; Lombardo’s mind-boggling drum dexterity, which roves from blastbeats to technical jazz; and King Buzzo’s gigantic sludge riffs to create controlled chaos in its most primitive, powerful form. They’ve covered The Godfather (1972), worked with free-jazz sicko John Zorn, and, most of all, done whatever they fucking wanted to. As long as they keep doing that, we’ll keep listening. (Daniel N. The workers at the Woodfin Suites Hotel in Emeryville have had to fight hard for their rights against an intractable employer — one with a history of harassment and denying them proper pay — but the workers could be on the verge of yet another small victory.

The Emeryville City Council could decide Monday, Dec. 1 whether to award about $200,000 in back wages owed to the workers, thus potentially touching off yet another chapter in a long legal battle pitting local workers and voters against a conservative, out-of-town hotel owner.

This case stems from Measure C, a living wage ordinance passed by city voters in November 2005 that was aimed at hotel housecleaners. The measure requires that hotels pay all employees a minimum wage of $9 per hour and overtime pay for workers who clean more than 5,000 square feet of floor space.

Brooke Anderson, executive director of the East Bay Alliance for a Sustainable Economy (EBASE), said the measure came about after talking to housekeepers who complained about the long hours and stressful workloads. EBASE, an Oakland community-organizing nonprofit, ran the campaign to pass Measure C along with UNITE-HERE Local 2850 and the Alameda Central Labor Council.

Rosa, a Woodfin employee who asked not to be identified, has cleaned the hotel’s luxurious suites for three years. She said that prior to Measure C’s implementation, she struggled to complete her daily workload. "It was an excessive amount of work. If we didn’t finish, we had to clock out and work without pay."

Through communication with the workers after the measure went into effect Dec. 5, 2005, EBASE found that Woodfin and the Marriott Courtyard Hotel were not in compliance. "We had workers start taking journals down saying, ‘I cleaned this many rooms today, what I should have been paid was X, what I did get paid was Y’," Anderson said.

By fall 2006, Woodfin and Marriott workers went public with their complaints, "essentially blowing the whistle on their hotels’ not complying with the law," Anderson said.

Both groups of workers testified before the City Council. Marriot quickly came into compliance, raising wages across the board and paying back wages for the year spent out of compliance. Woodfin slowly came into compliance, dropping the room load from about 17 to around 9 over the next three months.

Yet in June 2007, city officials found that Woodfin owed about $250,000 in back wages. The hotel appealed the ruling, arguing that Measure C was unconstitutional. In April, the Alameda Superior Court ruled that the law is constitutional and that the city of Emeryville has the right to demand back wages, but it took issue with the methodology used to calculate the owed amount. The judge ordered the city to revise its back wage order and hold another hearing.

The city reissued its order in August, calling for around $200,000 in back wages. Woodfin appealed the ruling; a first hearing was held Nov. 17, and a final decision is expected Dec. 1.

Woodfin’s argument this round, according to spokesperson Tim Rosales, is that Emeryville did not clarify its requirements until 2007 so the company cannot be held accountable for regulations it believed it was complying with. Rosales said the city passed "implementing regulations" in 2007 and "tried to retroactively apply those 2007 rules to 2006."

"It would be as if the IRS applied this year’s tax increases to last year’s taxes and asked you to pay the difference," he said. Additionally, Woodfin cleans each large suite with a team of housekeepers, making it difficult to calculate individual square footage.

EBASE counters that Woodfin purposely ignored Measure C’s regulations, which it vehemently opposed during the election. Anderson also said the hotel has a long history of using intimidation tactics throughout the two-year struggle.

The Guardian broke the story last year ("Calling in the feds," 6/13/07) that the owner of Woodfin Suites, Sam Hardage, used connections with US Rep. Brian Bilbray (R-San Diego) to have the Immigrations and Customs Enforcement officials audit his own hotel, which he then used as a pretext for trying to fire some of his workers.

"The real question," Emeryville City Council Member John Fricke told the Guardian, "is why has the Woodfin hotel chosen to invest so much money fighting Measure C.

"It’s pretty clear that the Woodfin has spent many times the back wage it owes and paid that to lawyers," he said.

Rosales said that the hotel was battling on a matter of principle. "One could argue that were going to be doing business in Emeryville for a very long time," he said. "We want to find some clarity on the issue so the city can’t adopt measures and apply them retroactively."

Both sides hope for a favorable outcome Dec. 1, but remain entrenched and ready to defend their positions.

"We are confident that a favorable decision will be made and we hope that the hotel will pay," Rosa said. "[The dispute] has made me stronger both as a person, and as a member of the working class."

Woodfin is confident but prepared to continue fighting.

"Really what we want to do is find some good resolution between ourselves and the city," Rosales said. If they don’t, he said, "I think we could find ourselves back in court." *

The United States of America and the Planet are teetering on the edge of economic and environmental collapse. We are now well aware of the threat of global warming and the catastrophic climate change it is causing. We know we have to curtail greenhouse gas emissions to heal the planet and sustain life on Earth. We are also in the midst of a serious financial crisis the depths of which we are coming to understand more and more as the days go by. But the economic instability we are experiencing is not just a result of toxic mortgage backed securities and the credit crunch. It’s not just the folly of Wall Street, it’s the folly of Big Oil, it’s the folly of our energy policy, and it is the folly of war.

We borrow trillions of dollars, mainly from China, to violently secure fossil fuel energy resources in the Middle East. This is not only environmentally unsustainable, it is economically unsustainable. Our current energy consumption and geo-political existence are destroying the planet and the American economy.
We are actually amazingly fortunate that there is one answer to our biggest problems. Clean Energy. We cannot save the planet from environmental disaster without developing clean and renewable sources of energy and we cannot save our economy in the long-term without becoming energy independent. Building a massive renewable energy infrastructure will heal the planet, stabilize the economy, create jobs, lift people out of poverty, and relieve us from war.

Our generation has a responsibility to figure this out now. San Francisco has the immediate opportunity with Proposition H to lead the world in the fight against global warming and lead the nation in the quest for energy independence.
Let’s not underestimate what one city can do. San Francisco has been out in front on so many issues in the past, from gay marriage to the most progressive minimum wage in the country. Two years ago a bunch of young workers in San Francisco past a paid sick days measure and now Barack Obama is talking about implementing it nationally. Just a few months ago a rag tag group of San Francisco activists put a 100% Clean Energy initiative on the ballot. A few weeks later, Al Gore issued his now famous energy challenge to America. If San Francisco passes Prop H, other cities and other states and countries around the world will follow.

We now face the biggest economic crisis since the great depression. It has become glaringly apparent that the free market and unregulated rule by private profiteering financial institutions and corporations is not a model that will sustain a healthy economy in this country. Wall Street’s greed has been matched only by Big Oil companies that have made windfall profits while moving at a snail’s pace towards developing alternative energy sources. In San Francisco, financial mismanagement of the private-investor owned utility PG&E has left us with skyrocketing electric rates for natural gas and a paltry supply of renewable energy. It’s time for the public accountability and stewardship of our energy resources and infrastructure that we will get with Proposition H.

At this pivotal moment in history we are faced with profound choices about our place in the world and our future on the planet. We can continue with the folly of national debt, oil profiteering and war or we can create a new clean energy economy, a fearless new ‘new deal’ that builds the next great public works projects, employs the next generation of workers, and ensures peace and stability in the 21st century. With Proposition H, San Francisco will be ready to work with the next President and the federal government to lead the clean energy revolution and build the renewable energy infrastructure that we need to sustain life on earth.

Two gardens, both erupting with a rich array of flowers, herbs, and veggies, offer a scrumptious glimpse into the promises and challenges of San Francisco’s food future.

One, a sparkling emerald Victory Garden, opened to much acclaim in front of City Hall this September to foreground America’s first Slow Food Nation gala. It’s an aromatic display of planter boxes boasting culinary items both mundane and exotic — a feast for the senses, if not the stomach.

Across town, far from the headlines and tourists, Alemany Farm sprouts loamy rows of greens and veggies, fruit trees, a heaping compost pile, a duck pond, a windmill, and more. Since members of this public housing community planted the farm’s first seeds in 1994, with help from the San Francisco League of Urban Gardeners, this urban agriculture venture has spawned harvests of fresh produce and some new sparks of hope for the area’s economically embattled residents.

These two boulevards of sustenance evoke an awakening of urban agriculture, and offer partial answers to an increasingly pressing question: in an era of global warming and fast-dwindling oil supplies, how will San Francisco sustain itself? Are city leaders and communities doing everything needed to make this happen?

The two gardens also put on display a key dilemma lurking just below the celebratory surface of food reform: who’s benefiting from the urban food renaissance, and who’s being left out of this virtuous banquet? How do we bring the good food limelight — and dollars — to the places and people that need it most?

PEAK OIL = PEAK FOOD


What does oil have to do with food? Everything. Our current food supply relies entirely on oil and cheap labor. As a nation we dump 500,000 tons of petroleum-based pesticides on our food crops each year, according to the EPA. Even the push for alternative fuels — namely ethanol — is steeped in the pesticide-intensive harvesting of corn. Then there’s the long polluting journey most of our food travels, more than 1,500 miles from the fields to your table — on diesel-guzzling semi-trucks, oil-greedy ocean tankers, and freight trains. All in all, it’s a toxic harvest whose days are numbered.

The stakes are high — very high. We are eating oil, and the clock is ticking. As journalist Erica Etelson wrote in the San Francisco Chronicle last year, "global oil demand is at 84 million barrels a day and rising, and there are at most a trillion barrels’ worth still in the ground, most of which is very difficult and expensive to recover. Do the math, and you’ll see that the end of oil is, at most, 30 years away." In response, the Board of Supervisors appointed a seven-member Peak Oil Preparedness Task Force in October 2007 that’s investigating ways to get San Francisco off oil — and food is a major ingredient in that mix.

According to the task force’s food issues member Jason Mark, roughly 500 acres of city and county land are "sitting idle and could be used for agricultural production." Meanwhile, hundreds of residents are lined up on community gardening waiting lists; if policymakers move the land and the people into production, and invested in urban agriculture education, the city "could begin to produce a significant percentage of its own fruits and vegetables," says Mark, who co-manages the Alemany Farm. "This would relieve some of the pressure from growers in rural counties, opening up more space for diversified agriculture and creating a more resilient food system."

RE-DEFINING ‘SUSTAINABLE’


As oil shortages and ecological collapse loom, other questions are bubbling up. What would it mean to make San Francisco — a city famous for its foodies and epicurean extravagances — "sustainable" in what its residents eat? How do we sustain ourselves in a way that sustains the region’s environment, food supply, and people’s health?

If you’re reading this article, chances are you’re hip to the idea of eating organic and local — perhaps you’re a "locavore" who studiously prioritizes a diet grown within a 100-mile radius of your home. Perhaps you’re a vegetarian who eschews animal flesh in the name of the environment, as well as health and ethics; or a conscientious "flexitarian" who only dines on sustainably farmed, humanely slaughtered meat. Perhaps you go the extra mile and buy a box of organics each week from a local farm. There’s no shortage of individual responses to the ecological nightmare of industrial food.

But what is the city’s collective response to unsustainable food? A new systemic approach is taking hold that goes beyond sustainable agriculture, to a bigger vision of sustaining people (farmers and consumers), communities, and economies, as well as the environment.

To Michael Dimock of Roots of Change, a leading California food reform movement, a core problem lies in the current system’s values — both cultural and economic. "We live in an environment where people want cheap food," often at the expense of sustainability, Dimock says. "We’re over-dependent on pesticides that have disrupted natural cycles," and that have "created an economic straightjacket for farmers … we’ve got to get away from these toxic chemicals without collapsing the system." Indeed, as oil prices have risen, pesticide and fertilizer costs have become a serious threat to farmers’ livelihood.

Labor costs chew up a major chunk of the food dollar — yet, farm workers toil for minimum wage in backbreaking conditions, and often live in ramshackle homes or canyons and ravines. Sixty percent of farm workers live below the poverty line. Meanwhile, meat factory workers suffer crippling injuries at alarming rates (roughly 20 percent a year) while laboring on brutal, dizzying-fast assembly-lines, typically for $8 per hour.

The solution lies beyond buying local and organic, and involves transforming food systems, locally and nationally (and globally) to meet an urgent array of needs: petroleum-free agriculture and food policies that build new infrastructures — markets, distribution channels, and a diversity of farms — centered on economic and ecological sustainability.

"It used to be about calories, now it’s about health — healthy people, healthy environment, and healthy communities," Dimock said. A blossoming "Buy fresh, buy local" label, an outgrowth of the Community Alliance with Family Farms, is building a network of local producers, distributors, and markets to simultaneously expand opportunities for smaller growers and access to fresh local foods for urban consumers.

But underlying tensions must be addressed: there are ongoing debates about what — beyond reducing pesticide use — makes farming "sustainable." Farms can be local and non-organic, or organic and non-local; or they may mass-produce a single organic crop for Wal-Mart or Safeway, depleting soils by monocropping, exploiting farm workers, and supporting corporate control over food.

SPROUTING CHANGE


Even in a city known for its conscientious consumption, industrially farmed and processed food remains a juggernaut. Fast food joints are plentiful, serving up fattening doses of unsustainably grown, heavily processed food. Most supermarket chains and smaller produce stores offer minimal organic fare at exorbitant prices, and often nothing remotely local.

More broadly, the city’s food infrastructure is a chaotic polyglot of stores and restaurants, with little design or planning to ensure health and economic diversity. In a market-driven economy, businesses simply rise up and succeed or fail — but food, like housing, education, and health, is a basic human necessity. As with most cities, there is no agency focused on making food sustainable in the broadest sense.

But sustainable foods policies are percoutf8g into the city bureaucracy — albeit sometimes piecemeal and slowly. In July 2005, city leaders made it official policy "to maximize the purchase of organic certified products in the process of procuring necessary goods for the city" — though adding, perhaps fatally, "when such products are available and of comparable cost to non-certified products." As it turns out, cost in particular (and supply to some degree) is a potential stumbling block to making this resolution a reality.

A Food Security Task Force, launched by the Board of Supervisors in 2005, is helping eligible families access and use food stamps, getting food to people in need while circuutf8g more dollars in the city. Getting food to hungry folks is an urgently needed service — but it doesn’t address the underlying poverty at hunger’s roots. Supplying charity food, while necessary on an emergency basis, does little to empower poor people to sustain themselves, and doesn’t ensure the food is healthful or sustainably grown.

Like most of urban America, San Francisco is a city of gastronomic extremes. Home to roughly 3,000 restaurants, triple-digit entrees, and a steady diet of haute cuisine celebrations, the city is an internationally renowned capital of fine food. For those with the money and time, Whole Foods Market and other venues offer bountiful aisles of organic produce, free-range meat, and at least some local fare.

But it’s not equal opportunity dining. For vast swaths of low-income and working class San Francisco, the options for good food are few and far between. Studies have found food "deserts" the size of entire zip codes, almost totally devoid of fresh produce — and other studies show this food gap causes serious nutritional deficits among the poor and people of color.

To put it bluntly, San Francisco suffers from food segregation. Apart from Alemany Farm’s oasis of green goodies, food-parched zones throughout the Tenderloin District, Bayview-Hunters Point, and other poorer quarters of town offer little more than liquor marts, convenience stores, and fast food chains with no fresh food or produce. It’s a surefire recipe for obesity, diabetes, heart disease, and other life-shortening ailments. As one food activist puts it, "homeless people are buying soda because it’s more calories for the money. Nobody wants hungry people — but it doesn’t get talked about."

BRINGING IT ALL TOGETHER


How can all these needs — at once potentially conflicting and unifying — be met at a time when ecological collapse requires radical change, and economic distress makes those changes tougher yet more urgent? A common refrain from activists and policymakers echoes: there’s a lot more we could do, if we had the money.

Dana Woldow, co-chair of the school district’s student nutrition and physical activity committee, says school lunches, once made up of "revolting carnival food," have improved greatly — but they can’t buy more local organic foods because "everyone’s getting hammered on transportation costs. Our district takes a loss on every meal."

A new revenue source, such as a gross receipts tax on large firms, could enlarge the public pie — if there’s the political will to do it. But the lack of cash to create a fully sustainable area food system also reveals a less-than-full commitment by city leaders to turn promising policies into everyday realities.

"Every city should have a food czar," argues Dimock, to "take the contradictions out of city policies," and develop new policies — and leverage state and federal help — to increase food security.

Ultimately the city could use a model food bill — a local, progressive version of the Farm Bill — to bring energy and money and policy coherence to the great work being done on the ground. In such a bill, new laws taxing fast food or high-end dining could create revenue to ensure all city agencies — and its schools, hospitals, and jails — abide by local and organic-first purchasing policies.

Healthy food zone rules could ensure food-deprived poor neighborhoods get targeted grants to promote businesses that feature local foods. And policies could support new urban agriculture ventures using city land to grow food and train and employ residents in need — improving nutrition and the economy.

In the long term, Dimock says, we need to restore our "cultural understanding of how agriculture and food is where humans have our most intimate contact with the natural world." The struggle to recover this is "a symbol of our divorce from the natural world, of leaving the garden. We need a new mythology — we need to return to the garden." *

Unaffordable nation

GREEN CITY Bay Area author Michael Pollan opened the first event of Slow Food Nation by pointing out that food prices have risen more than 80 percent in the past three years. "Food has emerged as one of the most important issues," Pollan said from the stage of the Herbst Theatre, where he was discussing "The World Food Crisis" with Indian author and activist Vandana Shiva, Slow Food founder Carlo Petrini, and authors Raj Patel and Corby Kummer in front of a sold-out crowd.

"Prices are going up, but wages aren’t," Patel said to Pollan, and the real crisis is in that gap between what people make and what people spend on food — and that includes the people who grow our food.

"The World Food Crisis" was one of several panels held during the three-day Slow Food Nation, the first major event staged in the United States for what has become an international movement focused on the pleasures and politics of eating. San Francisco, a city with a food consciousness that chimes with many tenets of the slow-food movement — and one with a proximity to fertile regions that provide a wide range of local food — seems the perfect host. An oft-repeated phrase at Slow Food events throughout the weekend was that eating healthy is a right, not a privilege.

But how can that sentiment be translated into sustenance? Can the people who grow our food even make a decent living? And how does an event where tickets went for as much as $159 focus on the needs of people who struggle just to get adequate nutrition?

This much is sure: prices may be up, but small farmers aren’t getting rich. "It’s very difficult for many of our farmers," Aliza Wasserman of Community Alliance with Family Farmers told the Guardian.

Jeff Larkey runs Route One Farm in Santa Cruz. He’s been farming for 27 years and rents 65 acres for about $45,000 per year because it’s too expensive to buy the land. In the past he’s worked up to 150 acres, but now, he said, "Going forward is a big question in my mind because the costs of doing business have skyrocketed so much."

Larkey has many long-term workers making wages that vary based on experience, with the bottom rung starting at or slightly above minimum wage. "I’d love to pay them all $20 an hour because that’s what the work is really worth," he said.

A way to solve the problem might be for growers to raise their prices — but many already consider organic, sustainably-grown food as fuel fit only for the well-heeled.

"To eat organic, healthy, local food generally costs more," Pollan admitted in a later talk. "The whole system is canted to support fast food. That’s what we subsidize."

He pointed out that Americans spend only 9.5 percent of their income on food — an all-time and international low — and people need to become more comfortable with paying more so growers and processors can earn fair wages. "We all need to spend some amount more on food."

That’s tough for people who can barely afford food now.

Anya Fernald, director of Slow Food Nation, said the group constantly struggles with the financial issue. Fernald also said proceeds from ticket sales will be used to seed future events and the next course of action, which will be determined by the farmers, food artisans, and nonprofits that participated.

When asked how they intended to get their message out to people who might have been priced out of attending the event, she said the group chose the Civic Center as a way to reach a broad audience. She pointed out that 60 percent of the events were free.

Pollan also said that policy needs to change to make food more accessible, and that’s what the Declaration for Healthy Food and Agriculture seems to speak to. The document was unveiled in the rotunda of City Hall on the eve of Slow Food Nation and outlines 12 principles that "should frame food and agriculture policy." Included are statements that affordable, nutritious food should be accessible to everyone and it shouldn’t mean exploiting farmers, workers, or natural resources to get it. Roots of Change, which coordinated drafting the declaration, is hoping for 1 million signatures by fall 2009, when they take it to policymakers in Washington, DC.

To surcharge, without love

OPINION With the first linen pants of 2008, this city commenced collecting employer contributions to the Healthy San Francisco universal health care program. Employers that don’t provide insurance now must pay the city for the public health care their employees use anyway. A number of restaurants have added "Healthy San Francisco" surcharges of 2 to 4 percent to diners’ tabs. These surcharges are at best sour grapes and at worst a diabolical plan to thwart democracy.

Present spite notwithstanding, I spend all my discretionary income on dining. My economic stimulus check stimulated some duck confit and tarte tatin. I’d trade a kidney for dinner at Coi. My disaster preparedness kit includes a Zagat Guide. The stokers of my culinary flame deserve to be treated well. Our restaurant scene should attract the best, the brightest, the most ingenuously-tattooed epicureans. The people of San Francisco deigned to achieve this noble goal by providing a higher minimum wage, paid sick leave, and now universal health care. Oh, the decadence! We’re drifting dangerously close to becoming a civilized society, which could get us invaded. Don’t be surprised when Blackwater goes hunting for Tom Ammiano in a spider-hole.

Some disgruntled restaurants have decided to assess a surcharge rather than raise prices. But all prices fluctuate. When the cost of electricity or halibut goes up, menu prices rise. Regulation affects cost. We knew that when we passed the laws. A surcharge instead of a menu price increase is restaurant owners’ way of saying that workers are less valuable than halibut.

Let them have health care. I enjoy clogging my own arteries so much more when the people feeding me get their cholesterol checked.

Owners claim their profit margin can’t absorb higher labor costs, hence the price hike. Restaurants have high failure rates and run a tight margin.

But raising prices wouldn’t be Armageddon for fine dining in Baghdad by the Bay. Heck, it’s not even Shock and Awe. Maybe I’d notice if Bar Tartine raised prices by 4 percent. Maybe I’d be annoyed. But if my $60 meal became $62, I wouldn’t head to a taqueria. The amount surchargers would have to jack prices before surchargees stay home is quite high. Most of us eating at Bar Tartine can suck it up like so many amuses bouches.

San Francisco Chronicle critic Michael Bauer is wont to blame every restaurant closure on our labor largesse. But restaurants fail for any number of reasons. Could be labor costs, or it could be that Bauer panned them, or that their concept, food, and location were bad, or that the manager was on coke.

Some restaurateurs can’t abide the people of San Francisco reguutf8g them. But that’s life in a democracy. The same people excusing the surcharge as mere kindly consciousness-raising are currently appealing the Healthy San Francisco law. In fact, the Golden Gate Restaurant Association opposes any improvement in labor standards. The folks there hope that diners, our fury stoked by surcharges, will finally rebel against our labor-loving local legislators, stop imposing our so-called values on restaurants, and demand to be served by disease-ridden, malnourished indigent waiters as God and Milton Friedman intended.

Instead of an irascible surcharge, menus could note: "Our food is organic, local, and sustainable. And the cook gets his asthma treated." People who care will be happy, and people who don’t will blithely resume checking the NASDAQ on their iPhones.

So quit grousing. Enjoy the short ribs. See your doctor. Everybody wins. *

We all know San Francisco housing is murder, with median rent for a one-bedroom apartment going for nearly $2200. So when I came home from college for my sweet but unpaid SF Bay Guardian internship, I knew I would have to be resourceful. I was prepared to live anywhere and do (almost) anything, as long as it was cheap. If you’re a local reading this via free wireless in your rent-controlled apartment (enjoy it while it lasts!), you may find this information irrelevant and stressful; or maybe you’ve been through it all. But if, like me, you can visit the beautiful Bay only for too-short summers, or you’re passing through or in transition, read on.

Home sweet hostel? Not if you’re local.

The USA hostel on Post, like most hostels, will sometimes let you work a certain number of hours per week in exchange for a free bed. You have to work at least 24 hours and the nightly rate is $25 for paying guests, so it comes out to about $7.50 an hour, well below minimum wage in San Francisco. When I tried to arrange things over the phone from New York, I was told by the bored-sounding receptionist that I would just have to show up for a couple nights so they could “see if they liked me.” That made me a little nervous, but since I’m not totally unlikable I still thought it was worth a try. When I checked in and presented my California driver’s license, I was told that I wouldn’t be allowed to stay unless I could show an out-of-state ID. Apparently the company has a policy against boarding California residents, a policy specifically designed (it seems to me) to keep out homeless people. This isn’t typical for hostels; places I’ve stayed in New York City are regularly used as stopgaps by people between apartments. I couldn’t help but think that the hostel shuts out native Californians to protect their guests (mostly drunk-ass Eurotrash on holiday) from the realities of life in SF, presenting a tourist experience in line with trips to Ghiradelli Square and Pier 39.That, plus the popularity contest application process, had me heading straight for the nearest internet café and the dizzying wilderness of options that is Craig’s List .

On Memorial Day, see “The Visitor”

On Memorial Day, see the movie now playing called “The Visitor.” We saw it at the Empire theater yesterday and it broke our hearts. It’s an honest poignant indictment of callous Bush detention and deportation policies of illegal immigrants that have largely gone unnoticed in the mainstream media.

A young Syrian “visitor” seeking political asylum is grabbed on the New York subway by the INS, slammed into an anonymous detention building in Queens with 300 or so other “visitors,” treated harshly, kept virtually incommunicado from his mother, partner, and an economics professor who gets pulled into the story and is trying vainly to help. Then the young man is jerked out of the building and sent summarily back to Syria to face probable political persecution. Bang, just like that. All done in INS bureaucratic secrecy, without due process or even the semblance of fairness or justice or sunshine.

Is this what our good service men and women are fighting for?

On Memorial Day, read the dispatch sent to me from Carolyn Schmidt, a free lance writer in Cedar Rapids, Iowa. She writes:

“The NYTimes story is the first piece I’ve seen on the big raid–the nation’s largest, according to reporters– on illegal immigrants at a Postville, IA kosher meat packing plant on Monday, May 12. (The May 24 NYT story was written by Julia Preston and headlined “270 Illegal Immigrants Sent to Prison in Federal Push.”

“St. Bridget’s Catholic Church opened its doors to the family and friends left behind when the INS (now called the ICE) swept into the plant, loaded people on buses, and transported them to the National Cattle Congress grounds in Waterloo.

“Our Cedar Rapids Gazette and the Des Moines Register have had stories about it all this past week and a half, but it is finally making it out to the national media.
The packing plant was abusing many of the workers–not even allowing them to take bathroom breaks, working 14-hour days, and paying them below minimum wage. So far the plant hasn’t been charged with anything, but charges MAY be coming. The Register story indicates that the company’s New York plant has been charged repeatedly.

“The people who are immediately prosecuted, of course, are the workers recruited to come up here and given false documents that they are now being prosecuted for having. Iowa is not the state you think of when the immigration issues are raised, but a similar raid was carried out in Marshalltown in January 2006. The Bush administration has found an easy way to make a statement, evidently. The attorneys representing the immigrants and the judges given this timetable by the feds all seem to be doing the best that they can.

“But running these people through hearings in groups of 10 and 20 does not seem like justice, in spite of what the attorneys say about their clients understanding the charges and being treated fairly. This is the biggest raid and the shortest time to accomplish it in U.S. history. The real culprit is the packing plant that recruited these workers to come here illegally, then abused them and underpaid them because the company knew they couldn’t complain to anyone in authority. So far the company has not been charged with anything. That is the travesty.”

Is this what our brave service men and women are fighting for?

Iowa made history by doing the right thing, voting Obama, and giving him the momentum that has carried him to near victory in the presidential primary. And now the ultimate irony is that the Bush administration, in this critical moment in the campaign, is making the case even stronger for Obama in the state where it all began.

It’s time for a change in Washington. ASAP. Support Obama. And support the GI bill, opposed by Bush and McCain with maddening duplicity and wrongheadedness. This is the bill that would show that this country on this Memorial Day and thereafter really remembers our fighting men and women throughout the years and really supports the troops fighting this Godawful war without end in Iraq for Bush and McCain.

What’s up with the restaurant surcharges?

The last time I had lunch at the Slow Club, the check came with a little notice: $1 was added to the cost of every meal to cover the cost of complying with the city’s new health-care mandate. That was fine — if I can afford to eat at the Slow Club I can afford an extra buck so the people who work there can get health insurance.

But it’s interesting that the place didn’t just raise prices by $1 (which most people wouldn’t have noticed — restaurant prices go up all the time). They made a point of letting everyone know that the money was for a new government mandate. It was, in its own way, a political statement: Hey, sorry we have to charge you more, but the city is forcing us to do it.

That’s made some local activists a bit angry (there’s a fascinating little bit on it in the San Francisco Magazine blog — Sup. Tom Ammiano (who wrote the health-care bill) and labor leader Chriss Romero were eating at 2223 Restaurant on Market, and Romero got pissed off when the tab came with a four percent service charge that mentioned the insurance rule.

I get Romero’s point, and we supported the Ammiano legislation — and as someone who works at a small business that has always provided health insurance to employees and is still getting hit with some serious additional expenses to comply, I understand why the restaurants are trying to make a point about it.

And it’s absolutely true that restaurants never do this when other mandates, taxes, fees and expensive compliance rules take effect (you never see it for increases in the minimum wage, for example).

New Deal Feted

The New Deal turned 75 yesterday, March 31st. About 150 people turned out to the Koret Auditorium in the main SF library to mark the occasion and to listen to a six-person panel discuss the series of landmark government initiatives. Supervisors Chris Daly and Ross Mirkarimi, two authors and two union organizers called for a return to the core principles of social justice and fair treatment that led to such things as minimum wage laws and the formation of social security.

“They did it in the 30’s, we can do it now,” Harvey Smith, adviser to the Living New Deal Project, told the audience. Smith was upset over the potential privatization of the Cow Palace, and joked that the city may sell of chunks of Golden Gate Park soon.

Sup Daly’s main concern was affordable housing and making sure the city represents ordinary people instead of big downtown businesses. “We don’t have enough resources to fund what we need, like schools and hospitals because we give corporations too many tax loopholes,” Daly said.

The panel urged the audience to organize their communities in fighting the privatization of San Francisco, which they said would make this city a haven for the elite. “The New Deal wasn’t just a gift from Congress, workers had to fight for it. If change is going to happen, it will be from the bottom up,” labor activist Karega Hart said.

TECHSPLOITATION The outrage over former New York governor Eliot Spitzer hiring an A-list hooker makes me feel like throwing a gigantic, crippling pile of superheavy biology and economics books at everyone in the United States and possibly the world. Are we still so Victorian in our thinking that we think it’s bad for somebody to pay large amounts of money for a few hours of skin-time with a professional? Have we not learned enough at this point about psychology and neuroscience to understand that a roll in the sheets is just a fun, chemical fizz for our brains and that it means nothing about ethics and morality?

The sad fact is that we have learned all that stuff, and yet most people still believe paying money for sex is the equivalent of killing babies on the moral report card. And yet nobody bothers to ask why, or to investigate past the sensational headlines. As far as I’m concerned, the one unethical thing Spitzer did was to hire a sex worker after prosecuting several prostitution rings. That’s hypocritical of him, and undermines my faith in him as a politician.

But let’s say Spitzer hadn’t prosecuted so-called sex crimes before, and all he was doing was hiring a lady for some sex. Here is what I don’t get: why is this bad? On the scale of things politicians can do – from sending huge numbers of young people to be killed in other countries to cutting programs aimed at helping foster kids get lunch money – hiring a sex worker is peanuts. It’s a personal choice! It’s not like Spitzer was issuing a statewide policy of mandatory hookers for everybody.

What really boggles the mind is the way so-called liberal media like National Public Radio and the New York Times have been attacking Spitzer’s morals as much as the conservative Fox News types have. In some cases, they’ve attacked him more. The reasons given are always the same: sex work is abusive to women (male prostitutes don’t exist?), and being paid for sex is inherently degrading.

Let’s look inside one of those heavy economics books that I just beat you with and examine these assumptions for a minute, OK? Every possible kind of human act has been commodified and turned into a job under capitalism. That means people are legally paid to clean up one another’s poop, paid to wash one another’s naked bodies, paid to fry food all day, paid to work in toxic mines, paid to clean toilets, paid to wash and dress dead naked bodies, and paid to clean the brains off walls in crime scenes. My point is, you can earn money doing every possible degrading or disgusting thing on earth.

And yet, most people don’t think it’s immoral to wipe somebody else’s bum or to fry food all day, even though both jobs could truthfully be described as inherently degrading. They say, "Gee that’s a tough job." And then they pay the people who do those jobs minimum wage.

The sex worker Spitzer visited, on the other hand, was paid handsomely for her tough job. The New York Times, in its mission to invade this woman’s privacy (though in what one must suppose is a nonexploitative way), reported that she was a midrange worker at her agency who pulled in between $1000–$2000 per job. She wasn’t working for minimum wage; she wasn’t forced to inhale toxic fumes that would destroy her chances of having a nonmutant baby. She was being paid a middle-class salary to have sex. Sure, it might be an icky job, in the same way cleaning up barf in a hospital can be icky. But was she being economically exploited? Probably a hell of a lot less than the janitor in the hospital mopping up vomit cleaning up after you.

Sure, there are hookers who are exploited and who have miserable lives. There are people who are exploited and miserable in a lot of jobs. But the misery is circumstantial: not all hookers are exploited, just as not all hospital workers are exploited. It’s basic labor economics, people.

Audacia Ray, former sex worker and editor of the sex worker magazine $pread, has pointed out that the public doesn’t even seem to understand what exploitation really means. The woman who did sex work for Spitzer has had her picture and personal history splattered all over the media in an incredibly insulting way. Nobody seems to realize she’s being degraded far more now than she ever was when Spitzer was her client. And she’s not getting any retirement savings out of it, either.

For those of us who are fascinated by the San Francisco taxi industry, there’s an interesting report from the city Controller’s office here. It relates to a few pieces of legislation that are coming up in the next few weeks. Sup. Michela Alioto-Pier wants to raise the amount big cab companies can charge their drivers to lease cabs — but the report shows that the big companies are all doing just fine, that revenue is up and that profits are healthy. That would suggest to me that they don’t need more money — which would come, of course, at the expense of the drivers, who would lose, according to the United Taxicab Workers, as much as $5,000 a year on the deal.

And let’s remember: According to the controller, the average driver nets less than $110 for a ten-hour shift, which is barely above the city’s minimum wage.

Alioto-Pier has backed off her initial plan, but there is likely some gate hike on the horizon — and in my mind, it needs to be combined with a fare increase to keep the drivers’ income from dropping.

Door-to-door “education”

Correction:

In “Door-to-Door Education” [10/24/07], we reported on a group called the San Francisco Homeless Services Coalition. Our story stated that 25 percent of the group’s income goes to overhead and in-kind donations. In fact, Daniel Rotman, the group’s director, says 10 percent of the income goes to overhead, 54 percent to “public education” (which includes door-to-door canvassing and fundraising), 13.5 percent to financial donations to local shelters, and 22.5 percent to in-kind donations. Our article also stated that the San Francisco Police Department was considering revoking the group’s charitable-solicitations permit and that department staff recommended the permit be revoked. In fact, the permit was extended for another six months while a decision on revocation is pending. The literature that the group was handing out early in its operation included the SFHSC name, address, and phone number.

While San Francisco’s problem of homelessness rages in the local streets and broadsheets, a Los Angeles–based organization that raises money for homeless people has set up a new shop in town. Situated in the high-traffic area of Seventh and Market streets, where the down-and-out regularly nap, panhandle, and hawk their wares, the San Francisco Homeless Services Coalition seems perfectly placed to lend a hand.

But a recent afternoon visit to its headquarters found the gate pulled shut, the door locked, and a person inside working at a computer while half a dozen homeless people loitered outside. Nothing, save a small piece of paper reading "SFHSC" posted in the window, indicated this was a place to give money or assist homeless individuals.

During another impromptu visit the gate was open and the room full of people — potential canvassers receiving instructions on going door-to-door to ask for $150 donations, which is how the group’s fellow organization, the Los Angeles Homeless Services Coalition, has raised more than $2 million in two years, according to its Web site.

When we asked for more information about the group, we were told it doesn’t print brochures or any kind of literature, in order to save money. A handmade business card with the phone number and Web site was given with an aside that we were "lucky to be getting that."

Concerns about the SFHSC have reached the San Francisco Police Department, which is investigating whether the door-to-door canvassers are carrying the proper identification and if that form of fundraising violates the group’s city-issued charitable-solicitations permit. The permit forbids soliciting within 10 feet of doors. A certificate of registration issued to the SFHSC on April 11 clearly states, "This does not authorize your organization to go door to door for solicitation. Public property only for charitable solicitation."

But the group has been knocking on doors in San Francisco for the past six months, telling people that "the best way to make a difference is by making a $150 tax-deductible donation," according to the script it gives its canvassers. It’s raised at least $100,000 so far in the name of helping the homeless, but its work has managed to alienate some of the local leaders it intended to support.

"There isn’t a relationship any longer," Erica Kisch, executive director of Compass Community Services, told us when asked about the three-month arrangement between the two groups during which the SFHSC agreed to donate 15 percent of its take to Compass. "We knew nothing about them. We met with the director. They said they were raising money for homeless services," Kisch said. "It was an opportunity, and it seemed aboveboard at the time."

Canvassers solicited with flyers clearly showing Compass’s name, federal tax-exempt identification number, and statistics but lacking the same details about the SFHSC. That caused concerned citizens to call Kisch. "We were getting inquiries from the community about what they were doing, their tactics. They were kind of aggressive, going up to people’s doors asking for a lot of money…. It wasn’t really clear to the people they were soliciting that money was going to direct services," she said.

In fact, most of it wasn’t. The SFHSC says only 15 percent of the money it raises makes it to the shelters and service centers. Most of the money raised goes to raising more money door-to-door — either to canvassers or their support staff — an effort the group calls "education." Kisch did some more research and ultimately decided "it wasn’t worth it to us to be attached to a controversial organization like that." Compass ended up receiving a total of $11,250 from the SFHSC.

Daniel Rotman, founder and executive director of both the SF and the LAHSC, said of the breakup, "Maybe they didn’t realize we’d be reaching so many people. I think we were just too new for them."

Rotman, a 27-year-old LA resident and UC Berkeley graduate with a degree in political science, used to work for the Democratic National Committee but decided politics wasn’t for him. He transferred the grassroots machinery of fundraising for politics to the particular issue of homelessness, he told us, "because I care. I’ve always been taken by the issue."

He confirmed to us that the SFHSC does not interface with needy folks — it just gathers money in their name. Homeless people who stop by the office are referred to other locations in the neighborhood and escorted out. Rotman said 15 percent of the net money raised is given to local groups, 60 percent goes to education, and 25 percent is for overhead, as well as a plan to buy delivery trucks for ferrying donated goods from homes to shelters.

"Our main goal is educating the community," Rotman said. "We don’t just raise money and give it to other groups. It costs money to set up speaking engagements and pay for field managers." But he admitted the SFHSC hadn’t done or set up any speaking gigs yet. The 10 to 11 canvassers employed at the SFHSC are paid minimum wage and earn a 30 percent bonus if they exceed a weekly office average. "They get that for going out into the community and informing people about the issue and about us. At the end we ask them to make a donation," Rotman said.

So the point of the canvassing is to educate, not raise money, but those who have received the pitch are dubious.

"It was not educational at all," one Bernal Heights resident said of her interaction with an SFHSC canvasser. "My husband works in that field, and I was surprised I’d never heard of them." She asked for a business card so she could do more research, but the canvasser had no printed materials. "Just a clipboard with names and addresses and a very vague petition." No envelope, no card, no pamphlet. "Basically, he was just asking for donations. I didn’t know what to think."

Besides the soliciting foot soldiers and an office at 1135 Market that’s so discreet it’s easy to miss, the group’s only public face is its Web site, www.sfhsc.org — a copy of the LAHSC site. "Who is homeless in San Francisco?" the Web site asks, but its answers don’t inspire a lot of confidence — they were clearly imported from our southerly neighbor. "50% of homeless adults are African American, compared to 9% of LA’s total population."

Paul Boden, executive director of the Western Regional Advocacy Project and former head of the Coalition on Homelessness, said he found out about the SFHSC from people who thought its canvassers were from COH. Boden, who’s been working on homeless issues since 1983, said none of his peers in LA had heard of the group, further raising his suspicions. "This group has to have one legitimate provider," Boden said. "One pimp group as the basis for all this funding — it’s a scam that’s as old as poverty."

Boden and Seth Katzman, director of Conard House, filed complaints with the SFPD that the SFHSC was vioutf8g the terms of its charitable-solicitations permit. An SFPD permitting officer confirmed the department had received concerned calls and a revocation hearing was held Aug. 15. Capt. Tom O’Neill said a backlog of work has kept him from releasing the final decision, but his staff has recommended the permit be revoked.

"Find out more before a gift is made," Bennett Weiner, chief operating officer of the Better Business Bureau’s Wise Giving Alliance, told us. He said legitimate nonprofits should make their annual report and other financial details publicly available and posted on a Web site.

And at the very least, they should have some flyers. "Not to have any literature available does raise potential concerns in donors’ minds," Weiner said. "It is something we encourage people to ask for."

Rotman told us the lack of literature was a fluke and the SFHSC always sends its canvassers out with four packets of envelopes to give to citizens. They’re required to knock on 75 doors, so it’s easy to imagine they might run out of envelopes.

The BBB also recommends that any such group be overseen by a board that meets three times a year, composed of at least five members, who should not make more than 10 percent of the organization’s total take. Rotman told us his board has three members — the IRS’s minimum legal requirement — and that he makes $36,000 a year. He could not provide annual reports or financial statements, explaining that the SFHSC is new and has had to rely on partnerships with fiscal sponsors.

Lisa Watson, executive director of the Downtown Women’s Center, said her group’s 17-member board of directors decided to terminate its relationship with the SFHSC after receiving $30,000. "Our board decided they didn’t think the canvassing was the way they wanted to go, because a certain percentage went to canvassing. Only a certain percentage went to us."

The LA Youth Network is the LAHSC’s current beneficiary, and director of administration Katherine McMahon expressed satisfaction with the relationship. "We work with homeless teens, and they’ve been an awesome advocate for us." The group has received more than $600,000 during the past two years.

Both Watson and McMahon said one of the benefits of the relationship with the LAHSC had been access to a new pool of donors, something that can be as important to many groups as money. "It’s more than raising money. Its building brand identity," Rotman said. In this case the "brand" is the problem of homelessness. "We have found more than anything that people in the community, based on our canvassing and talking to people one-on-one, there’s a general aggression from citizens and residents in the Bay Area towards the homeless." He wants to "talk to people on a one-on-one basis and say, ‘Hey look, it’s not necessarily what you think.’<0x2009>"

He said they’re raising empathy and support for public policy measures and "try to build up a little support for homeless services themselves." The SFHSC now partners with a different group every month, which will receive 15 percent of the net of its canvassing fruits.

"That specific setup, going door to door … this isn’t the way nonprofits in San Francisco raise money," Kisch said. "They’re pressing people to give $150 off the street. I would never give anyone that kind of money without more background on them. We were getting 15 percent after expenses. Where’s the rest of it going?"

41st Anniversary Special: Wrecked park

The San Francisco Recreation and Park Department has a long history of maintaining parks, community centers, and other recreational offerings. In fact, it controls more land in the city than any other entity, public or private. But after seeing its budget repeatedly slashed during lean fiscal years, the underfunded department has become a prime target for some controversial privatization schemes.

There are ongoing efforts to privatize city golf courses, supported by Mayor Gavin Newsom and Rec and Park general manager Yomi Agunbiade (see “Bilking the Links,” page 22). And there are ongoing fears that the city intends to privatize its popular Camp Mather vacation spot, something the RPD studied a few years ago and Sup. Jake McGoldrick has fought and highlighted.

Rec and Park has identified $37 million in needs at Camp Mather — the product of a private study the agency has been unable to fully explain to the public (see “From Cabin to Castle,” 4/4/07) — but left Camp Mather off a big bond measure planned for February 2008.

“They say $37 million you need up here, and how much you got in there for the ballot measure? Zip, zero,” McGoldrick told the Guardian. “It’s a familiar pattern: you underfund the hell out of something, and then you turn around and say, ‘We, the public sector, cannot handle taking care of this.'<0x2009>”

Rec and Park spokesperson Rose Dennis denies there are plans to privatize Camp Mather or that its omission from the bond measure is telling. “Many people disagreed — including you — with the funding needs and whether we could back it up,” she explained as the reason for its omission from the bond measure.

In his Oct. 1 endorsement interview with the Guardian, Newsom said, “We actually made some commitments just this last week with Sup. McGoldrick to help support his efforts, because he’s very protective of Camp Mather, and I appreciate his leadership on this, to help resource some of the needs up there without privatizing, without moving in accordance with your fears.”

And while Newsom said he hoped to avoiding privatizing Camp Mather, he refused to say he wouldn’t: “I’m not suggesting it’s off the table, because I’m not necessarily sure that the conditions that exist today will be conditions that exist tomorrow, and I will always be open to argument.”

But at least the Camp Mather and golf arguments have been happening mostly in public. That’s what voters intended in 1983 when they passed Proposition J, which requires public hearings, a staff study, and a vote by the Board of Supervisors before city services can be privatized. Yet over the past couple of years, there’s been an effort to quietly shift operations at a half-dozen rec centers away from city programs and toward private nonprofits.

It’s called Rec Connect. Its supporters bill it as an innovative effort to bring much-needed recreation programs to underserved, low-income neighborhoods. “This is a pilot program to see if a collaboration between a community-based organization and a rec center yields a richer program and a more engaged community,” said Margaret Brodkin, director of the Department of Children, Youth and Their Families, which created the program and oversees that and other uses of the city’s Children’s Fund.

But to members of the Service Employees International Union Local 1021 — which includes most city employees and has filed grievances challenging Rec Connect — the program is a sneaky attempt to have underpaid, privately funded workers take over services that should be provided by city employees, who are better paid, unionized, and accountable to the public.

“The city took funds from the city’s coffers and gave them to the Department of Children, Youth and [Their] Families,” Margot Reed, a work-site organizer for the union, told the Guardian. “DCYF is using these funds, through Rec Connect, to contract out to private nonprofits work that rec staff were doing for a quarter of the cost.”

Brodkin was the longtime director of Coleman Advocates for Children and Youth — a perpetual thorn in the side of City Hall and the author of the measure that set aside some property taxes to create the Children’s Fund — before Newsom hired her to head the DCYF. She sees her current role as a continuation of her last one, and she sees Rec Connect as an enhancement of needed services rather than a privatization.

“There is a commitment that no jobs would be lost. I’m a big supporter of the public sector,” Brodkin said, while acknowledging that the RPD is chronically underfunded. “I am certainly aware of the resources issue at Rec and Park…. I’d be a happy camper if the Rec and Park budget was doubled. But I’d still believe in this program and say it offers a richer experience.”

Rec Connect began in 2005 with a study that looked at unmet recreational needs and evaluated facilities that might be good places to bring in community-based organizations to offer specialized classes. The whole program was financed through a mix of public funds and grants from private foundations. The three-year pilot program started just over a year ago.

“The Rec Connects,” Newsom told the Guardian, “are a way of leveraging resources and getting more of our CBOs involved and using these great assets and facilities, instead of limiting use to the way things have been done.”

Rec Connect director Jo Mestelle denied that the initiative is a privatization attempt.

“Rec and Park brings the facilities, the sports, and traditional recreation. The CBOs bring the youth-development perspective and nontraditional programming,” Mestelle said. “Hopefully, together we build a community that includes youth-leadership groups and advisory councils.”

Few would dispute the need for more after-school or other youth programs, particularly in the violence-plagued Western Addition, where some of the Rec Connect centers are. But the means of providing these programs is something new for San Francisco, starting with the fact that even though Mestelle works in the DCYF office, her salary is paid for entirely by private foundations.

That relationship and those funders aren’t posted anywhere or immediately available to the public, but Brodkin agreed to provide them to the Guardian. They include the Hellman Family Philanthropic Foundation ($50,000), the Hearst Foundation ($50,000), the San Francisco Foundation ($128,000), the Haas Foundation ($100,000), and the SH Cowell Foundation ($150,000).

Brodkin and Mestelle characterized those foundations as fairly unimpeachable, and Brodkin defended the arrangement as part of a national trend: “The thing that’s odd about SEIU’s perspective is this is happening all over.”

That’s precisely the point, SEIU’s Robert Haaland says.

“It’s been a strategy since the ’70s to, as [conservative activist] Grover Norquist calls it, ‘starve the beast,'<0x2009>” or defund government programs, Haaland said. “On a national level there is a lot going on that impacts us locally.”

Minutes from a recent Recreation and Park Commission meeting confirm that rec center directors have only about $1,000 each year to cover the cost of buying basketballs, team jerseys, referee whistles, and other basic sports and safety supplies. The SEIU grievance also notes that recreation staff positions have decreased by a third just as senior management positions increased by a third.

“We don’t have enough dollars for $20-an-hour rec center staff who are directly responsible for the kids and are well known to the community. We believe kids deserve great coaches, consistency, longevity, and commitment,” Reed said.

SEIU Local 1021 chapter president Larry McNesby is also the Rec and Park manager who oversees Palega Park, one of the Rec Connect sites. He told the Guardian that while his rec directors are “under pressure from the mayor to show him numbers of people that they are serving,” Rec and Park’s new online registration fails to reflect the “hundreds of drop-ins” that rec staff serve on a daily basis.

But he said the department has been set up to fail by chronic underfunding.

“I’d love Rec Connect and DCYF to be on a level playing field, because my directors could out-recreate theirs any day,” McNesby said. “You can’t just eliminate our jobs and replace them with someone who makes just above minimum wage.”

Actually, Brodkin and Mestelle note that negotiations with SEIU over Rec Connect have resulted in a guarantee that no jobs will be replaced and an agreement by the city as to 250 different tasks that the Rec Connect CBOs can’t perform. Still, they say the program brings innovation to a stagnant city agency.

“Before Rec Connect the rec centers always had a Ping-Pong table and some board games, but some of them were really poor, many were tired looking, none had computers or Internet. So we’ve had to think outside the box. Rec [and] Park is a big department, and it’s not always efficient,” Mestelle said.

Public records show that in 2006, the DCYF, whose primary function is to administer grants, sent $1 million in public money to Rec Connect from the Children’s Trust Fund, a pool of cash the city gathers each year by levying 3¢ per dollar of property tax.

Both Rec Connect and city workers stress the importance of offering a range of good programs to young people. “Our work is at a more social level,” McNesby says. “Every minute a kid spends in a rec center is a minute they’re not breaking into a car or victimizing someone or being victimized.”

The question is who should provide those programs. “It’s society’s value system that controls where the money goes,” Rec and Park spokesperson Dennis said. “It’s a really provocative discussion. There are some very compelling trade-offs argued in convincing fashion by intelligent people on both sides. These aren’t easy decisions.”

But the union people say that when it comes to Rec Connect, that discussion isn’t happening in public forums in a forthright way. As Reed said, “Gavin Newsom never went to the voters and said, ‘Here’s what we want to do: cut the rec staff and bring in private nonprofits.'”

Breaking a sweat

When San Francisco took the national lead in eschewing consumer products made by workers forced to endure unsavory working conditions, Mayor Gavin Newsom positioned himself front and center on the issue.

Along with Sup. Tom Ammiano, Newsom coauthored the nation’s toughest municipal ordinance on the matter, requiring that the city and county of San Francisco purchase garments for its firefighters, police officers, Muni drivers, and others from manufacturers that can prove they don’t subcontract with sweatshops or mistreat workers themselves.

Putting the widely touted plan into action was another matter. Two years later, some appointees to the city’s newly formed Sweatfree Procurement Advisory Group, including former state senator Tom Hayden, say San Francisco is already failing to recognize its own commitment to human rights.

Several contractors who are set to provide the city with everything from bulletproof vests to uniforms for the Sheriff’s Department have received exemptions from the law, and nearly all of them have contracts lasting from three to five years — meaning it could be the next decade before the law has much impact.

The contracts in question total $7.2 million in value, according to city records.

"The waivers have no conditions attached," Hayden wrote in a recent letter to the mayor. "They give permission to continue avoiding compliance for several years…. We know from the city’s own staff that one supplier, Galls, produces in Colombia, a human-rights violator where scores of union leaders have been assassinated."

Hayden added in a phone interview that members of the advisory group have offered solutions to the city’s slow pace, but officials haven’t reacted. He met with American Apparel CEO Marty Bailey last month, and Bailey expressed interest in bidding on the city contracts, Hayden said, but the city hasn’t followed up with a meeting or conference call. Nor has it explored the option of joining contracts with "sweat-free" companies doing business with Los Angeles, Hayden contended.

"I’ve wondered if the procurement officials in San Francisco were being creative enough in looking for suppliers," Hayden said, "or whether they were looking at the same old handful of suppliers as if those people would change their ways."

Dozens of cities have such laws in place, but few have serious enforcement mechanisms. San Francisco was supposed to distinguish its ordinance in part by activating an agreement with the nonprofit enforcement body Workers Rights Consortium, which should already be inspecting manufacturing plants independently to ensure fair wages, benefits, and safety standards.

But enforcement, it turns out, is exactly where San Francisco’s law has so far fallen flat on it face, critics from the advisory group say. The group’s chair, Valerie Orth, an organizer for Global Exchange, said city bureaucrats promised to grant only short-term contracts until the law’s complex requirements were logistically workable.

Companies doing business with the city are often merely part of a supply chain that is coordinated with manufacturers abroad, so inspectors must track the conduct of subcontractors too.

The city, however, still doesn’t know the locations of some of the manufacturing plants where uniforms for sheriff’s deputies, meter enforcers, and many others are produced, Orth said, and with so many suppliers potentially receiving waivers, there’s no way to tell if, for instance, workers are getting a minimum wage.

Some businesses did provide info to the city on what outfits they subcontract with, but in one case the subcontractor, Fechheimer Brothers Co., didn’t comply with the law’s wage requirements, city records show.

According to Fechheimer’s Web site, the company has "manufacturing partners" in Central and South America, Europe, Africa, and Asia that "complement our three union plants in the United States." Fechheimer is participating in a three-year contract to provide uniforms to the city’s fire department.

"We’ve been trying to implement this law since 2005," Orth told the Guardian. "They’ve had time to try and figure out the kinks."

Orth said an executive from Fechheimer attended a recent advisory group meeting and complained that disclosing the location of manufacturing plants abroad would make the firm less competitive.

Newsom’s government affairs director, Wade Crowfoot, was unhappy when he discovered last week that Hayden and Orth had distributed a news release outlining their complaints. When we contacted the mayor’s media flak, Nathan Ballard, with questions, he responded only with an exasperated letter that Crowfoot had sent to the duo.

"Far from the doom-and-gloom portrait painted by the press release, the city remains committed to advancing the most aggressive anti-sweatshop law in the country," Crowfoot wrote. "While it may be frustrating to implement this incrementally, our experience with other groundbreaking legislation such as requiring domestic partner benefits suggests that remaining focused on removing the barriers to implementation — and working together to do so — is the only way to make this law fully operative."

Crowfoot added that the city wants to modify the law to reward contract bidders who are mostly compliant, but Orth and Hayden still worry that the city is simply prioritizing suppliers who are the least costly. According to Orth, "Once [contractors] figure out how they can get out of complying with the law in a city like San Francisco … they can easily get out of complying with laws in other cities."

Sup. Chris Daly, who was talking over the past few days about a campaign for mayor, has decided against it. He sent a statement tonight; I’ll post the whole thing:

Progressive Allies and Friends,

For the past 6.5 years, we have enjoyed strong
progressive politics in San Francisco. Progressive
San Francisco has delivered a new era of worker’s
rights with the nation’s highest minimum wage,
universal health coverage, and paid sick days.
Requiring significant amounts of affordable housing
and other public benefits, we’ve made development work
for communities. We’ve set the agenda on workers’
rights, housing, health care, city services,
transportation, and the environment. Our political
opponents, even holding the office of Mayor, have been
on the defensive.

Despite our political strength and its marquis
standing in local political races, it’s clear that
we’ve had difficulty engaging in this year’s Mayor’s
race. Progressives share a principled critique of the
personality-driven politics practiced by our
opponents. We elevate the issues important to
everyday people above our own political advancement
and personal self-interest. We are right to do so.
Unfortunately, this does not always translate well
into the mainstream and corporate-controlled media.

For the better part of a year, I felt a great deal of
responsibility to find a strong progressive candidate
for Mayor, all the while acknowledging that I was not
our best possible candidate. There were discussions,
caucuses, lunches, and even a Progressive Convention
aimed at compelling a progressive entry into the race.
With news last week of the final potential candidate
forgoing the race, I decided to take another look at
making a run.

This past week Progressive San Francisco produced a
flurry of activity about that possibility. I was
heartened and inspired that so many were willing to
step up in the face of significant odds. Dozens of
you dropped what you were doing to spend hours on end
with me this week. Hundreds pledged your support.
The outpouring gave me hope that we do have what it
takes to take back Room 200 and deliver social and
economic justice to San Francisco.

However, I have decided not to file a candidacy for
the Office of Mayor.

Given the negative, million-dollar campaign against me
last year, there was never a question that this
Mayor’s race would be brutal. The incumbent promised
as much in a meeting this week. Our ideas are better,
and I was committed to running a campaign about our
issues. But most of us had reservations about whether
we’d ever be able to achieve resonance on the issues
against the tide of hits, personal attacks, and media
hype of the Newsom vs. Daly personality clash.

Sarah and I arrived at last night’s meeting with the
intention of announcing my entry into the race and
were moved by everyone’s willingness to act on faith.
When I called on progressives for support for a
Mayoral run, progressives responded. But I also
sensed that the reservations in the room were real.
Progressives are certainly ready to vie for the
Mayor’s seat, but, unfortunately, I am not the right
candidate.

There is some good news. Progressives are much
stronger than we were the last time we didn’t field a
challenger for Mayor. Back in ’83, the progressive
movement had not recovered from the Milk/Moscone
assassinations and the subsequent repeal of district
elections. Dianne Feinstein enjoyed great popularity
after soundly squashing a recall effort. She went on
to easily win reelection later that year.

Four years later it appeared as if downtown’s reign
would continue with the front-running candidacy of
John Molinari. His bid, however, was upset when Art
Agnos united San Francisco’s left with a disciplined,
sustained, and effective campaign.

We all know that electoral work is just a part of the
overall effort we need to put forth. There is no
substitute for the basics of organizing and serving
our people so they can live with dignity. I will
always remain committed to the struggle and to
building progressive politics and people power in San
Francisco for the years to come.

Importing injustice

More than 100 tractor trailers were lined up at 6:30 a.m., inching toward the Port of Oakland’s Terminal 7, waiting for their next load. Against the backdrop of the San Francisco skyline, a mammoth freight ship emblazoned with the name Hyundai glided toward the port, pregnant with multicolor shipping containers.

A driver told the Guardian that he expected to be in line for at least two hours waiting to drop off the empty container attached to his big rig. His 1989 truck lacks air-conditioning, so the windows were rolled down, allowing diesel exhaust to pollute the air he was breathing.

It’s the same scene at many of the port’s other terminals: long lines of ancient trucks slowly snaking toward their destinations, their primarily immigrant drivers performing the essential and thankless task of transporting cheap clothes from Asia to the nation’s big-box retailers or helping to export California’s agricultural goods to Hawaii.

The fourth-busiest container port in the nation, the Port of Oakland is the economic engine of the region, providing thousands of jobs and more than $1 billion in revenue. But activists say that the port system has also led to sweatshoplike conditions for truckers and created a health crisis for the surrounding community.

On their poverty-level wages, truckers are usually able to buy only the oldest, most polluting trucks. Their diesel pollution is a major factor driving asthma rates through the roof in the neighboring, primarily African American neighborhood of West Oakland, where, the American Lung Association says, one in every five kids has asthma.

A new national coalition of labor, environmental, and community activists has advanced a proposal that would make all drivers employees with benefits, radically changing the way work is done on the waterfront and possibly heralding the return of the Teamsters to the ports for the first time in more than 20 years. In the process, the proposal would make the port’s biggest customers responsible for its environmental problems.

The coalition places the blame for the current situation squarely on giant retail shippers such as Wal-Mart and Target and is calling for them to be held accountable for the full environmental and labor costs of the cheap goods they sell — a call the corporations are strenuously resisting. The American Trucking Association, whose members contract directly with the corporation, has threatened a lawsuit if the change is adopted. But port officials have voiced a willingness to seriously consider implementing the proposal.

Having long claimed that the trucking industry is outside its control, the Port of Oakland could embrace the proposal as a means of satisfying community, environmental, political, and business concerns. With impending directives to clean the air coming from Sacramento, trade planned to almost double by 2020, two new Port Commission appointees representing labor and environmental concerns, and a federal antiterrorism tracking plan slated for this fall, the port is poised to play a leadership role that could reverberate up and down the West Coast and across the country.

THE TRUCKER’S LIFE


The Port of Oakland’s estimated 1,500 to 2,500 drivers are a far cry from the middle-class, long-haul Teamsters and the Smokey and the Bandit–<\d>style freewheeling rebels who have long been engrained in the American imagination. Instead, they are at the bottom of the port’s food chain and are the most exploited trucking sector in the country, consisting primarily of recent immigrants struggling to make ends meet.

Dawit Fre, 39, immigrated to Oakland from the small nation of Eritrea two years ago. "I wanted to see a better life," he told us. Fre was a driver in Africa and went to work for the Port of Oakland after his cousin told him people start their trucking careers there. He said he works up to 60 hours a week for one company, making the equivalent of about $8 an hour after expenses.

Fre arrives at work every day no later than 6:30 a.m., waits for dispatches from his company, and spends a minimum of two hours in line for each container he picks up or drops off. He is paid $42 for each load by the company. He doesn’t know how much the trucking companies make but has heard that some get $200 per load. He returns home around 6:30 at night.

"The whole time I’m at the port, I’m thinking about my family," he said. "I got children. The only thing I’m thinking inside the terminal is, how many moves am I going to do? Am I going to do four or five or three or two?"

On a good day he can get four, on a bad day as few as one, depending on the length of the lines and the generosity of the dispatcher. Then there are his expenses. As an independent operator, Fre is solely responsible for a tankful of diesel that costs him up to $250 a pop. DMV registration is $178 a month, and 12 percent of his weekly earnings goes to his boss for insurance on his truck, not to mention annual federal income tax.

He receives no benefits, no overtime pay, and no health care coverage at a time when his wife, a diabetic, is suffering from severe stomach complications. "I’m taking her to Highland Hospital," he told us. "If it’s easy for them to fix, they can do it. But if she has a big problem, they can’t do it."

Fre has his own health problems. "Most of the drivers, we have old trucks," he said. "You don’t have AC, your windows are down, and you get sick in the truck" from the diesel. Fre’s remedy for his persistent coughing and the burning in his throat is several glasses of milk after each day of work.

A 1998 study published in the Journal of Independent Medicine found that truck drivers face a risk of cancer 10 times greater than Occupational Safety and Health Administration–acceptable levels, and a 1990 study published in the American Journal of Public Health showed that truckers face nearly double the average lifetime lung cancer risk.

Fre has little money to invest in his truck, a ragged 1987 model that he said needs $5,000 in repairs. He doesn’t trust it on the freeway, so he’s asked his dispatcher to send him only from pier to pier, not outside the port, further dipping into his earnings. "I came here to see a better life," he said. "When I got here, I found it is different. Here we don’t get paid for the overtime. We don’t get benefits. When I get into the terminal, there is no respect."

His experience is typical of those of port truckers across the country. A study by the East Bay Alliance for a Sustainable Economy, a labor-affiliated think tank, found that the average Port of Oakland trucker makes as little as $8 an hour after expenses, works 11 hours a day, and spends two and a half hours in line per load. Almost none of the truckers reported receiving benefits on the job, and 66 percent don’t have health insurance.

This is consistent with data from a 2004 survey of port truckers in Los Angeles and Long Beach, conducted by a professor of economics at California State University Long Beach. That report found they had a median income of $25,000 a year after expenses and an average workday of 11.2 hours, with up to 33 percent of their time spent waiting in line.

Port truckers generally drive only the oldest, most polluting trucks because that’s all they can afford. An industry adage is that ports are "the place trucks go to die," a reality that has dire impacts on the surrounding communities.

POLLUTING THE COMMUNITY


West Oakland has long been a dumping ground for the Bay Area’s toxic waste. The community has one of the five highest asthma hospitalization rates in California, with an estimated 20 percent of its K–<\d>12 students suffering from the disorder, according to the ALA. Researchers at the University of Southern California have found that children living within a few hundred meters of freeways leading out of ports not only are more likely to suffer from asthma but also actually develop smaller lungs.

Margaret Gordon, a 60-year-old community health activist who has lived just blocks from the Port of Oakland for 15 years, told us that she and four of her grandchildren living with her all suffer from asthma. When one grandchild was born with severe asthma and her own asthma worsened after she moved to West Oakland, Gordon, then a housekeeper, started reading about the causes of asthma and made the connection to the port. Like many in the low-income neighborhood, she cannot afford to move elsewhere in the Bay Area.

Gordon has been fighting for clean air for more than a decade, and in April she was inducted into the Alameda County Women’s Hall of Fame for her work. In 2001, Gordon formed the West Oakland Environmental Indicators Project, which she now cochairs. The project has released more than half a dozen studies related to air quality. A 2003 report showed that trucks traveling through West Oakland in one day produce the same amount of toxic soot as 127,677 cars, leading to indoor air in some neighborhood homes that is five times more toxic than that in other parts of the city.

Still, Gordon told us that port officials are "only starting paying attention." Last year the California Air Resources Board passed a resolution related to air quality at ports and announced that it was developing a regulatory mechanism. A 2006 CARB report found that truck diesel exhaust accounts for the majority of the estimated 2,400 deaths related to freight transport each year and 70 percent of the state’s air pollution–<\d>related cancer risk. Freight transport will cost California residents $200 billion in health costs over the next 15 years. Most of this is borne by low-income communities of color near freight transport hubs.

The combination of state mandates and local community concerns is starting to spark a change. "They would sit down and talk with us before that, but there was not anything concrete done," Gordon told us. The port is now in the early planning stages of an air-quality-improvement program, working with Gordon and other activists.

That movement is getting vigorous new support from the Coalition for Clean and Safe Ports, a national partnership of labor, environmental, and community activists organizing at the country’s major container ports: Los Angeles, Long Beach, Miami, Oakland, New York–New Jersey, and Seattle.

"Every one of those ports has the same environmental and labor problems we have in Oakland," Doug Bloch, the coordinator for the coalition in Oakland, told us during a tour of the port’s heavy industrial landscape. Virtually all of its 900 maritime acres are covered by concrete and asphalt, monster cranes that inspired Star Wars‘ Imperial Walkers, and 20-foot steel containers stacked up like Legos behind chain-link fences.

The Port of Oakland has no direct relationship with its truckers at the present. Shippers take price bids from among roughly 100 trucking companies at the port, then contract the work to the independent-contractor truckers. The CCSP says bidding wars lead to poverty wages for truckers, older trucks and more pollution, and a chaotic port full of inefficiencies like long pickup waits.

Under the proposed system, ports would call on their ability as landlords to set standards for the trucking and shipping companies. They would require trucking companies to hire drivers as employees, shifting maintenance costs from the drivers to the companies, which would retrofit or replace all port trucks with more environmentally friendly rigs. The ports would allow only new, cleaner trucks to enter. The companies could then, in theory, pass the costs on to shippers and end users.

If drivers were paid as employees by the hour instead of by the trip, the coalition expects the market would reduce inefficient truck wait times and air pollution.

"When you rent an apartment you sign a lease," Bloch told us. "If you trash the place, you get evicted. Corporations are trashing this community, but they’re not being evicted."

A test case could soon be under way at the ports of Los Angeles and Long Beach, the two largest in the United States, and the situation is being closely watched by ports and industries across the country. Port commissioners there had hoped by the end of this month to approve the coalition’s program, which they expect to reduce diesel truck emissions by as much as 80 percent over the next five years. But growing opposition and the threat of lawsuits by groups like the California Trucking Association, which represents the owners of truck companies, and the Waterfront Coalition, a consortium of major retailers, led the ports to delay their decision. The commissioners now expect to vote in September after completing an economic impact survey.

At the center of the storm is the fact that as employees, truckers would be able to organize and form a union. As independent contractors, they are barred from doing so because of antitrust laws originally created to oppose vast enterprises that dominated industries. (A further irony is that giant retail steamship companies have experienced incredible consolidation and enjoy a limited antitrust immunity.)

If passed by LA port officials, the plan would be implemented there starting Jan. 1, 2008, and could result in a domino effect at the other, smaller ports across the country. "The industry is fighting like hell in LA," Bloch told us. "They know that if they’re going to have to pay, the party’s over."

Meanwhile, Bloch told us that more than 1,000 truckers have signed a petition asking the Port of Oakland to pass a version of the coalition’s proposal, and it will be presented to the Port Commission, the seven-member body that would eventually vote on the proposal. Spokesperson Libby Schaff told us that the port "agrees with the coalition that the port can and should have a more direct relationship with its truckers" and is "very seriously considering the coalition’s proposal."

Because the proposal "constitutes a major overhaul of the way trucking is done today," Schaff said the port is currently holding stakeholder meetings with residents, truckers, terminal operators, elected officials, the business community, and labor to consider it in the context of a more comprehensive port plan. Schaff said a comprehensive plan could be crafted in less than a year.

The port has not taken a position on granting truckers employee status. It is also looking into other funding mechanisms for a clean-truck program, including money from a pending state bill that would impose a $30 fee on every 20-foot-equivalent unit passing through the Los Angeles, Long Beach, and Oakland port complexes, to be used for improvements in road and rail infrastructure and for clean-air programs.

The legislation, Senate Bill 974, by Alan Lowenthal (D–Long Beach), would generate more than $525 million annually. But it faces tough opposition from some very powerful interests.

RESISTING CHANGE


Bill Aboudi, president of Oakland’s AB Trucking and a member of the CTA, told us truckers are "treated like second-class citizens," and he believes long lines and trucker asthma are serious problems. But he strongly opposes the coalition’s proposal. Instead, he told us, state regulations like those forthcoming from CARB and other piecemeal reforms are the answer.

"The coalition’s main goal is to unionize the drivers," Aboudi said. He was wearing a baseball cap emblazoned with two American flags and the words "Oakland Trucker." An immigrant from Israel, he has been at the Port of Oakland since 1992. "If these guys choose to be owner-operators, why are you rocking the boat? You can’t be playing with my livelihood just because you want to get union dues," Aboudi said. "Truckers want to own a piece of the American dream. They want to own their own truck."

It’s an appealing image to many. Kevin Leonard, an owner-operator trucker who contracts with Aboudi and others, told us he doesn’t want to give up his independent status. "I have the freedom to work when I want," he said. "I don’t see how the Teamsters can represent me better than I can."

The trucking industry as a whole says the coalition plan will force away trade and drive out small trucking companies, which will have to maintain the trucks and start paying benefits such as health insurance and workers’ compensation.

Yet Assemblymember Sandré Swanson (D–Oakland) brushed aside those arguments. "I’ve been involved in Bay Area politics for more than 30 years," he told us. "I’ve seen these same claims made against farmworkers as they were organizing for better conditions. I’ve seen these arguments made when we were raising the minimum wage. I think the opposite is true. If you have a workforce with a livable wage, it’s a more productive workforce, and I think everyone benefits. Truckers deserve more, and we’re going to do what we can to help them."

Oakland City Council president Ignacio de la Fuente, who drafted and helped pass a minimum-wage law for port employees, told us he supports the right of truckers to unionize but labor and environmental concerns must be balanced with economic growth. "You can’t ignore the fact that you have the port of Oakland competing with other ports," he said. "I support the fact that the Teamsters are going to bargain collectively on a national level. This port competes with other ports, and you cannot be put at a disadvantage."

Bloch says the coalition’s target is the shipping companies, not the trucking companies. "The shippers are hiding behind the trucking companies," he told us. "On the one side there are the giant shipping companies, like Wal-Mart and Target, huge global companies that demand low prices from trucking companies. On the other side are tiny trucking companies, immigrant truckers, and communities of color. Wal-Mart’s slogan is ‘always low prices,’ but ‘always low prices’ means one out of five children in West Oakland with asthma and drivers making $8 an hour who can’t support their families."

Oakland mayor Ron Dellums may be signaling his support for reform with two new appointees to the Port Commission. Even before he took office, Dellums was working to influence the Port Commission; as mayor-elect, he requested that outgoing mayor Jerry Brown hold off on appointing a new nominee so Dellums could appoint someone working on environmental and community impacts. He lost this battle when a majority of the city council voted to appoint Mark McClure, the director of marketing at a business technology company focused on security.

Dellums’s latest appointees, announced earlier this month, are a marked contrast to the business-oriented appointees of the Brown era: Victor Uno, a financial secretary with the International Brotherhood of Electrical Workers, and Gordon, the longtime resident and environmental activist in West Oakland.

"The port’s policy has been all about business and not about the people," Gordon told us. "The mayor really wants someone there to talk about health issues. I have never known a mayor to put someone on the commission and one of their engagements is to talk about health." She would also like to see a public participatory-process policy built into the port. "This is about sharing the power," Gordon said. "I don’t think West Oakland residents know they have power." She has "no problem" with truckers unionizing but also wants to find a way for drivers to remain independent contractors if they prefer.

Uno told the Guardian that he is highly supportive of the proposal. "I think that if the whole commission takes the lead of Mayor Dellums that this proposal will be very seriously considered," he said. "I’m very optimistic." Asked if he thought a proposal could succeed without requiring trucking companies to hire truckers as employees, he said, "I do not see how that is possible, given the lack of regulations in the trucking industry. It’s a dog-eat-dog world among independent truckers."

DEREGULATION HISTORY


The ports were not always structured as they are now. Before the 1980s the Interstate Commerce Commission regulated trucking, and most truckers at California ports were members of the Teamsters. They had health care, pensions, and workers’ compensation insurance and were paid a middle-class wage.

As part of a national push toward deregulation in the late 1970s, Congress, spurred by President Jimmy Carter, deregulated the trucking industry in 1980. In the following few years, a flood of new trucking companies entered the ports, with shippers choosing between a growing number of companies for each job. As small trucking companies undercut one another in bidding wars, the falling rates translated into declining driver pay, the bankruptcy of Teamster-organized companies, and increasing reliance on independent contractors whom companies could hire without spending money on payroll taxes, health care costs, or other benefits that unions might try to extract.

Trucking expert Michael Belzer, an economics professor at Wayne State University, has shown that long-haul truckers now earn less than half of prederegulation wages and work an average of more than 60 hours a week, while retailers like Wal-Mart have thrived. "The low rates paid to truckers in this global-trade game acts as a subsidy for increasing the amount of trade," Belzer told us. "Pollution and safety hazards are the negative externalities." If all ports on the West Coast required employee drivers, he said, "the market result would be that cost and safety would go up, and pollution would go down."

There have been a handful of Teamsters-related or trucker-led rallies and work stoppages at the Port of Oakland since deregulation, including a technically illegal strike in 2004 protesting the soaring price of diesel fuel, which virtually shut down the port for eight days. Many of the same complaints of today’s port truckers were aired at that time — long waits in lines, poor pay, long hours, and no benefits.

"This business is like the Mafia," Lorenzo Fernandez, 36, said, standing in front of two metal taco trucks glinting in the noon sun, along with about a half dozen other truckers on their lunch break. "They’re doing whatever they want with us, between the [truck companies] and the shippers. There is so much competition between the companies, and they know that we need the job. They know that our kids will go hungry."

Muhammad Khan, 33, said he’s sometimes forced to make up for long wait times by driving dangerously fast on the freeways. "We have our families. We have to take care of them. We all risk our lives because we have to. We don’t make enough money if we don’t make a load," Khan told us.

"We’re all immigrants here," Fernandez said. "We make it possible for the economy to grow up, but they’re stepping on our faces…. We have to work together. Otherwise we are going to be slaves for life."

A sign on a chain-link fence near the taco trucks reads, "Got an old truck? The Port of Oakland can help! Replace your old truck today!" Call the number at the bottom of the sign, and a recorded message issues an invitation to an informational barbecue that took place four months ago. The message explains that the port will provide qualifying owners with up to $40,000 to replace trucks dating from 1993 or before with a 1999-model truck. But Schaff told us, "Due to overwhelming demand, new applicants are currently not being accepted."

Money for the program came from a $9 million settlement of a lawsuit West Oakland residents filed against the Port of Oakland in 1998, alleging that their health was being harmed by port operations. The port says it will replace a total of 80 of the estimated 2,500 port trucks with those funds. When asked if the port had a responsibility to truckers, Schaff said it was "consistent with the port’s commitment to social responsibility…. We’ve done a lot, and we’re going to do more."

But the only specific programs the port could point to were the truck replacement program, a trucker access committee and working group started after the 2004 strike, and new GPS cell phone technology that is being touted as a solution for bottlenecks. Chuck Mack, the Teamsters’ Western Region vice president, isn’t impressed. "They’re a joke," he said of the programs. "Very few independent contractors have utilized them."

The recent purchase of the GPS system particularly irritates Mack. "Here is a quasi-governmental agency supplying services to the trucking companies," he told us. "It’s bizarre that we’re using taxpayer money for this. Any other industry would buy the devices themselves."

"We don’t disagree with using this money" for truck replacement, Mack said, "but what you’re doing is blowing $2 million in taxpayer money. Years down the road they’re going to need a new truck and another million in taxpayer money. For Wal-Mart and Target it’s great because they can have the taxpayer pick up the bill. Without changing the model, it’s just a short-term fix at the expense of the taxpayer."

EMPLOYEE BENEFITS


Beyond the environmental and economic benefits of making truckers employees of the companies, the change also might improve port security. The federal Transportation Worker Identification Credential program, expected to be implemented in the fall, will check the identities of the nation’s 750,000 port employees, 110,000 of whom work as truckers. Under the present system, there is no way to track the independent port truckers.

Employees are easier to track, and they are also better for port security in other ways. Among low-paid port truckers, turnover rate is extremely high, according to the ATA. "We all know that having a stable, well-trained, reliable workforce only leads to more security," Bloch said. "If they’re trained, they can be the eyes and ears of the port."

Well-paid truckers also would lead to safer ports. In a 2005 report, Belzer showed that "a substantial fraction" of independent operators actually loses money each year, resulting in "a high risk of unsafe operations among those earning the least money." The low compensation also "presents a national security risk," his report read, "since those who desperately work to break even might be at risk to engage in activities that put the nation at risk, whether intentionally or unintentionally, just trying to find a way from not going under."

Driving past another long line of trucks idling outside a gate after lunch break, Bloch pointed out one truck. A placard on the back of the rig read, "End sweatshops on wheels."

The current port system "just heaps abuse and abuse on these truck drivers and this community," Bloch told us. "The big businesses like Wal-Mart don’t pay the cost of polluting Oakland. It’s the truck drivers and the community that pay the cost. People pay with their lives."

"You can’t fix the environmental problems without fixing the problems of the driver," he said. "And now you have labor and the community coming together, and that’s powerful."*

Calling in the feds

An upscale Emeryville hotel embroiled in a nasty, yearlong labor dispute appears to have called on the owner’s conservative political connections to bring about an immigration audit of the hotel. Worker advocates say the move was an effort to intimidate immigrant workers involved in a campaign to enforce a living-wage law.

Kurt Bardella, a spokesperson for US Rep. Brian Bilbray (R–San Diego), told the Guardian that a representative of the Emeryville Woodfin Suites contacted Bilbray’s office for assistance Feb. 1.

The request came within weeks of Alameda County Superior Court and Emeryville City Council rulings requiring the Woodfin to rehire the 21 workers it fired just before Christmas, allegedly due to worker Social Security numbers not matching federal records. That injunction was in effect pending an investigation of workers’ claims that the hotel had retaliated against them for organizing to enforce Measure C, a living-wage law passed by Emeryville voters in 2005.

"We were contacted by one of the HR people at the Woodfin Suites," Bardella told us. "They told us about the situation" and explained that they "had no mechanism" to deal with it, he said.

Bilbray, who chairs the House Immigration Reform Caucus and is one of the most vocal opponents of the recent immigration bill, wrote directly to the head of Immigration and Customs Enforcement (ICE) in February to request that it investigate the immigration status of Emeryville Woodfin Suites employees in order to "to create a mechanism for the employer to address this issue."

Bilbray represents the suburban San Diego district in which Woodfin Suites president Samuel Hardage lives. "We treated this as a constituent issue," Bardella told us.

Hardage is not only a constituent; he has consistently contributed to Bilbray’s campaigns for at least the past 13 years, donating $4,200 in 2006. A George W. Bush Pioneer, having raised $100,000 for the 2004 election, Hardage is also a major player in California and San Diego Republican politics.

Workers say the ICE audit was an intimidation tactic that should not have been used against them while they were trying to assert their rights, and ICE’s internal policies raise questions about whether the agency should have gotten involved in this labor dispute.

For months the Woodfin Suites has tried to justify firing workers who organized for better labor conditions by alluding to fears of reprisal by ICE. In a May 8 San Francisco Chronicle op-ed, General Manager Hugh MacIntosh castigated the East Bay Alliance for a Sustainable Economy (EBASE), a labor-affiliated think tank that supports the hotel’s workers, for "resorting to well-worn intimidation schemes to secure workers’ support for their organization drives."

The "fact that our hotel has been asked by the U.S. Immigration and Customs Enforcement to provide employment records, coupled with the agency’s raids in the Bay Area, suggests that our actions are anything but voluntary," he wrote.

The Bilbray connection significantly undermines this claim and could be significant in a pending state lawsuit by the workers. It is against the law for an employer to fire workers for organizing for better working conditions, regardless of immigration status. Under current immigration laws, however, it is also common.

"Employers often contact immigration authorities … in order to avoid liability," Monica Guizar, an attorney with the National Immigration Law Center, told us. "It is a well-known and documented tactic that employers use to stymie union organizing campaigns [and] escape liability for vioutf8g workers’ rights."

In recognition of this abuse, memorandums from the Department of Labor and internal ICE regulations have been established to dissuade worksite interventions when a labor dispute is occurring. Advocates have successfully invoked these guidelines to terminate deportation proceedings and prevent raids in the past, but immigrant workers are still incredibly vulnerable.

ICE Special Agent’s Field Manual section 33.14(h) requires that agents use restraint where a labor dispute is in progress and the complaint about employees’ immigration status "is being provided to interfere with the rights of employees to … be paid minimum wages and overtime; to have safe work places … or to retaliate against employees for seeking to vindicate those rights."

Additionally, a 1998 memorandum of understanding between the Department of Labor and ICE (then known as the INS) directs immigration agents to "avoid inappropriate worksite interventions where it is known or reasonably suspected that a labor dispute is occurring and the intervention may, or may be sought so as to, interfere in the dispute."

Guizar confirmed that these regulations are still in place under ICE. Monica Virginia Kites, a spokesperson for ICE, declined to comment on these internal regulations.

At a noisy Saturday-morning picket in front of the Emeryville Woodfin Suites, Luz, a 42-year-old from Mexico City, told the Guardian that managers never questioned her immigration status during the three years she was a housekeeper at the hotel — until she started working with EBASE to enforce Measure C.

One day, Luz told us, her manager rushed her and other workers into the hotel’s attic, because "ICE was driving around outside and could come." According to Luz, the manager told them that "this could be a result of us supporting Measure C or working with EBASE."

The measure mandates a $9 per hour minimum wage for hotel workers and requires overtime pay for employees who clean more than 5,000 square feet of floor space during a shift. The Woodfin contributed $27,500 to an anti–Measure C campaign committee, filed two unsuccessful lawsuits that challenged its constitutionality, and then simply failed to comply with the law.

"They said we weren’t entitled to rights because we were immigrants," Luz recalled. "They started to say that our Social Security numbers didn’t match and that we would have to leave. This problem never came up until we asked for our rights."

In September 2006, Woodfin workers filed a class-action lawsuit seeking back pay. The Woodfin finally agreed to come into compliance with Measure C the following month, but it also told almost 30 workers that it had found problems with their Social Security numbers. On Dec. 15, the Woodfin suspended 21 workers and gave them two weeks’ notice that they were to be fired.

On the extensive Web site the Woodfin has devoted to the dispute, the hotel claims it was "forced to move to terminate their [workers’] employment" after receiving Social Security Administration "no-match" letters for them. "Today," it claims, "failure to act appropriately on a no-match letter may be considered evidence of an employer’s conscious disregard for the law."

This is false, according to Social Security Administration spokesperson Lowell Kepke. It is in fact "illegal for a company to fire an employee based solely on a no-match letter," he told us.

Because it has been so often abused, the letter itself states that employers "should not use this letter to take any adverse action against an employee…. Doing so could, in fact, violate State or Federal law and subject you to legal consequences."

An emergency ordinance returned workers to the Woodfin while the city investigated their retaliation claims, but on April 27 the hotel defied the ordinance by firing 12 immigrant workers, again citing problems with Social Security numbers.

The city issued a notice of violation; even probusiness city council member Dick Kassis, who opposed Measure C, called the Woodfin’s behavior "morally reprehensible" at a May 1 council meeting. On May 3 police arrested 38 people at a civil disobedience protest supporting the workers in front of the hotel, including Assemblyperson Loni Hancock and Berkeley city council member Kriss Worthington.

The almost maddeningly soft-spoken and reasoned Emeryville city council member John Fricke, who in February was the target of an unsuccessful restraining order filed by the hotel over his alleged "threatening" behavior, posed the following conundrum to us: why would a successful business continue to pursue litigation that is not cost-effective?

"I’m assuming their success is based on their business acumen," he said. Yet as a lawyer, he estimates that attorney fees are well above $100,000, on top of another $100,000 in fees borne by the city and at least that much in worker back pay. "You would think the wise business decision would be to cut one’s losses," he said.

One possible answer: EBASE organizer Brooke Anderson said this is actually an "ideological battle."

The Woodfin’s Hardage has spent more than $230,000 since 2000 to fund conservative politicians and ballot measures, including political committees that have taken antiunion and antitax positions on state and local ballot propositions, according to EBASE. He chaired the San Diego County Republican Party from 1995 to 1997 and has served as a fundraiser in several Republican campaigns.

Hardage cofounded the Project for California’s Future in 2001, which the Heritage Foundation describes as "a multi-year, multi-million dollar project" to prepare Republican candidates for California office and "represents a first-ever program to rebuild the conservative bench from the water board level on up."

The project’s cofounder is Ron Nehring, the passionately antilabor vice chairman of the California Republican Party and senior consultant to Grover Norquist’s Americans for Tax Reform. Nehring was also once director of government affairs for the Woodfin Suites.

A 2005 report by the Center on Policy Initiatives, a progressive think tank, names Nehring, Hardage, and Norquist among those who have helped the Republicans target San Diego as a model for their plan to radically cut government funding, permanently weaken labor unions, and privatize public services.

The ideological battle manifested itself at the Saturday-morning picket, which pitted roughly 15 College Republicans from Bay Area schools against 25 laid-off workers and supporters, each group with a bullhorn, separated by barricades and cops.

The Woodfin provided free rooms for the student counterdemonstrators, Ryan Clumpner, a UC Davis senior and chair of the California College Republicans, told us. Surrounded by signs such as "Quit ‘Stalin’: Get Back to Work," and "Respect the Law," Clumpner said he was "here supporting the Woodfin, which is being unfairly targeted by unions."

"I’ve actually done housecleaning," he said. Between semesters one summer, he said, he made $7 an hour cleaning rooms at UC Davis; immigrants supporting families in the Bay Area should also be content with this wage, he said. "If they want to make more, they can move up to supervisor positions," he said. "They’re here for a reason. This country is offering economic opportunities. The economic benefit is the reason they’re here, not the problem."

On the other side of the barricades, Luz said, "My idea is that you have to work hard and give a lot to the company so that they give something back to you in return. We gave them the best service, so they should give us reasonable salaries."

Retaliatory actions against immigrants organizing to improve their work situations have increased across the country in the past few years, just as high-profile raids have resulted in the detentions, arrests, and removals from the United States of thousands of immigrant workers.

The Woodfin is "an example of the need for just and fair immigration reform, coupling the legalization of undocumented workers in this country with strong labor- and employment-law enforcement," Guizar told us.

City Manager Pat O’Keefe told us that in the coming few weeks the city will be announcing a decision about its investigation into worker complaints and the Woodfin’s operating permit. *

The Wild, Wild West

As a production assistant for a visual effects studio, Robert Seeley had a job at the Orphanage that was nuts and bolts for the movie industry — handling paperwork, overseeing schedules, arranging deliveries, and making sure folks were fed, clients were happy, and many of the million little logistics for a film project were coordinated.

His days began with an hour-long commute from Pleasant Hill to the Presidio, where the Orphanage is based. Mornings started around 9, and the typical workday ran about 10 hours. Or it did when he started there, in July 2006.

"There was a snowball effect. It started out as a regular 10-hour workday. It slowly built to 12, then 16," Seeley told the Guardian.

At one point, Seeley charges, he was asked to work a 20-hour shift — and return to work two and a half hours later. When he didn’t come in, he was fired.

Seeley sued, and the case was eventually settled. But along the way, the lawyers for the Orphanage raised a startling argument: since the Presidio is a federal enclave, they said, California labor law, which restricts the length of shifts, doesn’t apply.

"This was a really straightforward, meat and potatoes case," Seeley’s lawyer, Steve Sommers, told the Guardian. "And if he worked across the street, it would have been a slam dunk."

If the legal argument advanced by the studio as a response to Seeley’s lawsuit is right — and some labor experts say it may very well be — then none of the private companies that lease space at the Presidio have to follow any state or local labor laws. That means no California or San Francisco minimum wage, no workplace safety statutes, nothing. And since state law is generally far tougher than federal law, the difference could be profound.

There are hundreds of people working for private companies in the Presidio, which operates under a unique arrangement that allows private, commercial development in a national park.

Federal regulations are almost always weaker than California’s — and not necessarily improving. "Federal laws are evolving backwards for the most part," said Katie Quan, associate chair for Labor Research and Education at UC Berkeley. "There have been attempts to weaken benefits, Social Security, who can and can’t join unions. Even the new minimum wage that’s been passed — there’s a big question as to whether or not [George W.] Bush will sign it."

While California’s minimum wage is $7.50 and San Francisco’s is $9.14, the federal hourly rate is currently $5.15 — and arguably the only one that applies in the Presidio.

Several employment lawyers contacted by us initially suggested that California’s labor statutes would have to apply in the Presidio, but Chris Cannon, a lawyer familiar with the situation, did not.

"I’ve gotten a lot of people acquitted on a criminal basis applying that same validity," he said of the cases the Orphanage’s lawyers used to back up their argument. "It’s like a little piece of Nevada here in California."

Cannon has litigated several cases in the Presidio, most notably on the controversial issue of where and when dogs can be off leash. "Given the history of the Presidio, I think there’s a very good argument that California laws don’t apply."

It’s easy to extrapolate that nothing that’s been passed in Sacramento or at City Hall would apply to the Presidio, including the recent universal health care plan passed by the Board of Supervisors and the paid sick-leave that voters approved.

The upshot: the author of the bill establishing the Presidio park, House Speaker Nancy Pelosi, who is a big favorite of organized labor, may have created a place where private employers can freely flout state and local laws designed to protect workers.

Lieutenant Jeff Wasserman of the US Park Police, which has exclusive jurisdiction over the Presidio, said, "We only have to follow federal laws. However, the US attorney has in the past asked us to adhere to state laws simply because they think it’s the right thing to do."

One of Wasserman’s examples involved a California law that speed limits may only be adjusted based on recommendations from a traffic engineer, which was established to prevent cops from setting speed traps. To Wasserman’s knowledge, California is the only state with this restriction, and it’s been extended to the Presidio. "The US Attorney felt that it was fair that if the surrounding streets followed it, we should too." He added that juvenile arrests in the Presidio have also stood up in local courts because the federal laws are so weak in that regard.

Two dozen companies contacted by us were asked questions regarding employment protocol, and all said they paid San Francisco’s minimum wage or better and insisted they followed both federal and state labor laws. The largest employer in the Presidio, LucasFilm, did not respond to the questions.

Carsten Sorensen, CEO of the Orphanage, said, "We follow the letter of the law. We were told by our attorneys, being in the Presidio, we fall under the federal labor law."

He did say, "Of course we want our employees to be safe and do whatever we can to make sure that happens. There’s no chronic issue of people who are dissatisfied with the working conditions."

But in responding to the lawsuit, his company didn’t even try to defend its practices. Instead, Judith Droz Keyes, a lawyer with the firm Davis Wright Tremaine, argued in a Jan. 24 letter that "California has no jurisdiction either to legislate or enforce its laws within the federal enclave. The fact that the Orphanage is a private company leasing space within the Presidio makes no difference."

The Presidio Trust — the semiprivate agency that manages the park — did not respond to requests for comment, and it’s unclear how the outfit treats its own workers. Discrimination based on sexual orientation, for example, is not a part of the federal Equal Employment Opportunity laws, but it is a part of California’s, and even the Presidio Trust’s own personnel manual mandates it.

To require anything definitive and absolute would take an act of Congress to mandate the Presidio adhere to state or local ordinances. We tried to reach Pelosi’s office to ask about it, but she didn’t return our calls.

In the meantime, Sommers said, "The Presidio Trust could insist that all vendors abide by California state labor laws. Then large employers in the Presidio would have to treat their workers like citizens of California." *
