Newsom’s budget and DCCC hypocrisy

Hypocrisy hung thickly in the air at City Hall today as Mayor Gavin Newsom refused to responsively address glaring contradictions on a pair of high-profile policy stances, pursuing naked self interest while cloaking himself in deceptive but high-minded rhetoric. Newsom used the city budget-signing ceremony to effusively praise the labor unions that he publicly shamed into giving back $250 million over two years to balance the budget without tax increases, a budget that cut services and increased various fees and fines.

“Labor has been under attack in this state and country. They’ve become a convenient excuse for our lack of leadership in Sacramento and around the country,” Newsom said without blushing, defending unions against pension reform measures such as Public Defender Jeff Adachi’s SF Smart Reform, which he opposes while continuing to support the need for pension reform.

But Newsom seemed unaware that the layoffs, forced furloughs, and voluntary pay cuts accepted by the unions that he publicly demonized just a couple months ago and now praises – whose support he needs for his current run for lieutenant governor – is connected to his steadfast opposition to new taxes, which he reiterated today: “We balanced the budget without raising taxes. I don’t believe in raising taxes, we don’t need to raise taxes.”

Despite the fact that just 10 percent of San Francisco businesses pay any business taxes to the city, Newsom opposed and this week helped kill a measure by Board President David Chiu to reform the business tax system in a way that would increase taxes on large corporations, lower them on small businesses, create private sector jobs, bring $25 million per year into the city, and expand the tax burden to 25 percent of businesses, including the large banks, insurance companies, and financial institutions that are now exempt. Instead, labor took a deep hit and the city still faces projected $500 million budget deficits each of the next two fiscal years.

But Newsom’s hypocrisy isn’t confined fiscal issues. After the ceremony, he told reporters that he was sticking by his November ballot measure to ban local elected officials from serving on the Democratic County Central Committee, even after last night insisting that body give him a seat, which they had to change the bylaws to accommodate.

At last night’s DCCC meeting, members of an elected committee that includes four progressive supervisors and three current supervisorial candidates called for Newsom or his proxy John Shanley to explain why he is pushing a policy to ban locally elected officials from serving on the DCCC, a body in which elected state and federal officials automatically get seats.

“This mayor is on record as saying local officials should not serve on the committee,” Sup. David Campos said at the meeting, calling for Newsom to clarify this policy contradiction and offer his reasoning for the policy: “We don’t want to do anything that is inconsistent with what the mayor has said so far.”

Chair Aaron Peskin translated Campos’s comments as indicating “some level of irony or hypocrisy,” but Campos objected, insisting “it’s not a personal attack” but a genuine desire to know why Newsom sought to ban local elected officials after progressives won a majority of the DCCC seats in June.

Both Shanley last night and Newsom today gave the same legalistic answers, noting that he’s not serving in his capacity as the mayor, but as an ex officio member who automatically gets a seat for being the Democratic nominee for a statewide office (although the DCCC legal counsel said Newsom wasn’t entitled to a seat because the bylaws only award a seat when the current holder of the office being sought is a Democrat).

But DCCC member Carole Migden objected to Shanley’s answer, saying of Newsom’s effort to unseat duly elected members, “That’s picking a fight, if we want to be clear…That effects my vote, I have to say. It’s disrespectful and unconstitutional.”

DCCC member David Chiu noted that Newsom’s ballot measure would explicitly ban supervisors and the mayor from serving on the DCCC and said that the mayor still had a few days before the deadline for him to withdraw the measure, which he single-handedly placed on the ballot using his authority as mayor.

But today, when asked by the Guardian, Newsom said he had no intention of either withdrawing the measure or explaining it to the DCCC. When we asked about the contradiction in his positions, Newsom said only, “If the voters support it then it would be the right thing to do.”

He was similarly dismissive when other reporters continued to ask about the controversy, gesturing toward me with a dismissive wave of his hand as he said, “Certain people with certain newspapers major in the minor.”

After being told that Newsom is sticking by his DCCC ballot measure, Chiu told us, “I hope the mayor can move beyond the politics of personality and build a party vehicle that is about unity.”

 

Immigrant advocates protest AZ law and Jerry Brown’s SecureComm support

The SF Pride action came on the heels of yesterday’s protest in which over a hundred people gathered in front of the federal building to rally for comprehensive immigration reform, oppose AZ’s SB 1070 law and to oppose the fingerprinting program that was imposed on SF known as S-Comm (i.e., Secure Communities), effectively undermining the city’s sanctuary ordinance. Nineteen people were arrested for engaging in civil disobediance and blocking Seventh Street.

Today, several more immigrant rights rallies are taking place, including one outside the San Francisco office of gubernatorial candidate and Attorney General Jerry Brown. The protest, which was organized by the SF Day Labor Program and the Women’s Collective, targets Brown for not supporting San Francisco Sheriff Mike Hennessey’s request to opt San Francisco out of the  S-Comm program. 

Meanwhile, over at City Hall, San Francisco Mayor Gavin Newsom said he doesn’t see any problem with the SecureComm program.
“There is no reason to opt out,”Newsom told reporters at a budget signing press conference.

Board had to ask for Lennar’s approval…

The Board of Supervisors found itself in the humiliating position July 27 of having to ask for the approval of Lennar and the city’s Redevelopment Agency before it could amend Lennar’s massive redevelopment plan for Candlestick Point-Hunters Point Shipyard.

If that’s not an argument for reforming how this city approaches redevelopment, I don’t know what is. Especially since the Board’s meeting illustrated only too well how thoroughly Lennar’s local executives, who used to work for the city under Mayor Willie Brown,  understand this game and how to outfoxed any resistance to their ongoing effort to eat San Francisco whole.

“This is a rare opportunity,” Sup. Sophie Maxwell said ahead of the Board’s 10-1 vote (Sup. Chris Daly was the lone dissenting voice) to approve Lennar’s entire plan. “It focuses public and private investment into an area that has lacked it in the past,”continued Maxwell, who represents the district that encompasses the shipyard and Candlestick Point. ” It’s unmatched by any development project in San Francisco. This project is large and complicated, no doubt. But let us not be fearful of this project because of its scale, because how else can we transform a neglected landscape?”

But who wouldn’t be afraid of a deal that found Maxwell, Board President Chiu and Sups. Michela Alioto-Pier, Carmen Chu, Bevan Dufty and Sean Elsbernd joining forces to vote against Sup. Ross Mirkarimi’s proposal that Lennar be required to include a non-bridge alternative?

And who wouldn’t be doubly afraid, given that these six supervisors took that vote after Michael Cohen, Mayor Gavin Newsom’s top economic advisor, was unable to point to a single document to support his claims that Lennar’s $100 million bridge over an environmentally sensitive slough is actually needed?

Talk about scary.

To his credit, Mirkarimi did a good job of illustrating what’s wrong with a process that allows a private developer like Lennar to pitch plans and get mayoral appointees to approve them, but doesn’t allow San Francisco’s elected officials to make any amendments unless the developer and Redevelopment agree.

At the root of this travesty is the fact that redevelopment law trumps municipal law, a power imbalance that creates a shadow government in those few municipalities in California where the city council or board of supervisors is not the same entity as the Redevelopment Commission.

San Francisco is one such municipality, and, as Mirkarimi explained, this is not the first time that Redevelopment’s plans have trumped the concerns of local residents.

“I’m the supervisor for the Fillmore, the first urban renewal laboratory took place in my district, and I vowed to never let it happen again, ”Mirkarimi said, referring to the massive displacement of African Americans and Japanese Americans that took place when Redevelopment decided to makeover the Fillmore in the 1960s.

“I’ve been told, “Don’t worry, Ross, this is not going to happen. We’re not going to use eminent domain,’” Mirkarimi continued. “Well, Jeez, that’s a consolation! Because even when we’ve exercised our legislative influence and given our blessing, [Redevelopment] unilaterally changed the plan after it left the Board. That suggests a condescending role in which the developer is able to go to the Redevelopment Commission and have a unilateral change.”

Mirkarimi was referring to how proposed rental units on Parcel A, the first parcel of shipyard land released for redevelopment, became for-sale condos at Lennar’s request, without the Board having any recourse, even though the area surrounding the redevelopment is ground zero for the city’s last remaining African American community and home to other low-income communities of color.

Deputy City Attorney Charles Sullivan explained that the s supervisors would require the approval of the developer and Redevelopment to amend Lennar’s latest plan, under Redevelopment law. Failing that, their only recourse would be to reject Lennar’s plan in its entirety–a nuclear option that only Daly seemed prepared to carry through.

Sup. David Campos noted that the city’s legal advice had been “somewhat of a moving target.” His comment suggested the Board had  been misled in the critical weeks before this final vote, including ahead of the Board’s July 14 vote to accept certification of the project’s final environmental impact report.

“When a number of us raised questions about the EIR, we were told we couldn’t, but that we would probably be able to make changes to the substantive plan,” Campos recalled. “But now we are getting a more complicated answer.”

Deputy City Attorney Sullivan said the situation was complicated, because some of the proposed amendments “don’t involve a simple stroke of the pen.”

But Campos pointed to the fact that Board President Chiu had introduced an amendment that only allows for a 41 ft. bridge across Yosemite Slough, thereby halving the width of the 82 ft. bridge that Lennar is proposing to build.

That amendment, which Chiu introduced July 12,  leaves the door open for the 82 ft. version of the bridge, if the 49ers indicate interest in a new stadium on Hunters Point Shipyard, a possibility the city claims is still alive, even though Santa Clara voters approved a new stadium for the 49ers this June.

“So, why can you amend the plan to include a scaled-down version of the bridge but not eliminate it altogether?” Campos asked.

“You can make that motion by voting not to approve the project,” Sullivan said.

“So, the change has to point to something already embedded in the project?” Campos asked.

“Or not be a rejection of everything that’s already been brought forward,” Sullivan replied.

After Mirkarimi proposed his no-bridge alternative, along with a slew of other amendments that Daly, Campos, and Sups. Eric Mar and John Avalos had been working on to strengthen the proposed development, Cohen, Mayor Gavin Newsom’s top economic advisor, huddled somewhere in City Hall along with Kofi Bonner,  Lennar’s top local executive and Fred Blackwell, the head of SF’s Redevelopment Agency to decide which of the Board’s amendments they would accept.

Cohen returned with the amendments organized into three categories: acceptable as written, modified, and completely unacceptable.

And predictably enough (to anyone  tracking Lennar’s insistence on a bridge) Mirkarimi’s no-bridge amendment had been tossed into the “unacceptable” pile.

“With regards to your insistence on the economic reasons for the bridge, please point to which document says that,” Mirkarimi said, leafing through the project materials that were piled on his desk.

Cohen mentioned a number of factors, including an alleged “lessening of attractiveness,” “a lower density product” and a reduction of property tax revenue that would be available through tax increment financing to pay for Lennar’s proposed bridge.

“Yes, but I’m still trying to look for the information, and all I’m hearing is this pitch,” Mirkarimi replied. “The economic study is absent. There are no supporting documents here. This is why I feel it’s justified for use to have a review of this.”

Cohen talked some more about “rigorous public discussion over a number of years.”

“But there is no economic study,” Mirkarimi repeated. At which point a deafening silence pervaded the Board’s venerable chambers, much as if the emperor had shown up without his proverbial clothes.

Deputy City Attorney Sullivan broke the silence by indicating that the only way for the Board to move a no-bridge alternative forward would be to stop all project approvals and send the plan back to Redevelopment.

And Mirkarimi reminded the supervisors that at the Board’s July 13 hearing, Cohen had said that there was no conclusive evidence around the need for the bridge.

But then the Board voted 6-5 against Mirkarimi’s proposal, a move insiders said was more about not pissing off Labor, which hopes to create jobs for iron workers, and not pissing off Lennar, whose control runs deep and wide, and less about being convinced of the actual need to build over the last unbridged waterway in the city’s southeast sector.

And a couple of amendments later, the Board gave its blessing and it was all kisses and hugs and applause in the Board Chambers, even though the folks from Dwayne Jones Communities of Opportunities (COO) program, who usually show up to support the plan, strangely weren’t in attendance, rumoredly because their program has been cut off at the knees in the last few weeks, following Jones resignation as COO’s director.

“I wish we had been able to eliminate the bridge,” Campos told me after the Board’s final vote. “I think part of the challenge we have is to reexamine how Redevelopment works and explore the potential for taking it over.”

Mirkarimi was satisfied that he had dissected the arguments against the no-bridge alternative, but feared that institutional memory is lacking on the Board, and that without fundamental Redevelopment reform, the city is in danger of seeing this kind of travesty repeated, over and over.

“A lot of my colleagues have not been involved in the debacle,” Mirkarimo said, referring to how Redevelopment’s infamous role dates back five decades, and how Lennar has been working the local political scene for longer than most of the Board’s current members.

But Maxwell was all smiles.
“I did my homework a long time ago, that’s why they couldn’t touch the core of the project,” she said. “They just added to and augmented it.”

With Maxwell’s days on the Board drawing to a close, I asked what she’s contemplating doing next.

“Sophie is looking into water policies and conservation,” Maxwell said. “Without blue there is no green.

It was about then that Mayor Gavin Newsom released a press statement that blabbed on in vaguely frothing terms about what would happen next.

“Now we can truly begin the work of transforming an environmental blight into a new center of thousands of permanent and construction jobs, green technology investment, affordable housing and parks for our City,” Newsom said

His words came shortly before Bonner said that Lennar would now start looking for investors, and shortly after Cohen admitted that it could be years before anything in Lennar’s plan actually gets built. But none of them mentioned that the Sierra Club and other environmental groups are planning to sue the City over the bridge, an outcome that could have been averted, Sierra Club officials warned, if the No-bridge alternative had been  included in the final redevelopment plan.

You can’t walk by Martin’s 16th Street Emporium without ogling the ghoulish delights displayed in the windows. Casual strollers might be forgiven for thinking the place is called “The Skull Store” — an apt description, anyway, considering that the store is stuffed floor-to-ceiling with skulls galore. Though it’s not open very often (try Thurs.-Sat. afternoons — look for the pirate flag out front), it’s well worth a special visit to pick up a gift for your favorite skull collector. A gorilla sits in Japantown’s classic origami store. She’s squat and a little wrinkly, but say what you want about her lumps and rolls, she’s fantastically multidimensional — and even carries a little baby on her back. Even before it opened, Candy Darling had a reputation, thanks to its fabulous name and kicky red plastic sign. Passersby were left to wonder — would it be a candy shop, or a drag queen fashion emporium? Those with a sweet tooth were the ones who received the happy answer, though, to be honest, there’s something wonderfully Grey Gardens about the store’s vintage 1960s or ’70s feel. Candy Darling the Warhol superstar was utterly unique, the essence of feminine glamour, and as soft and lovely as a lilac-scented breeze. A great bookstore is almost like an inspiring place of worship, except more fun and more grounded in palpable truth. Way out west, where Midwestern dreams take form, there’s a Victorian that predates the great 1906 quake. There, you’ll find men’s workwear goods refined to something like an art form. They’re well-arranged in a shop known to sport an American flag or two, not in any jingoistic way, but as a reflection of its “finest quality dry goods”: jeans, shirts, bags, boots, and other masculine items, all selected by Todd Barket, whose design eye has influenced some of the more popular mass-market clothing brands on Market Street. The attire in Unionmade is considerably pricier for the most part, but with a sharpness, durability, and practical ingenuity (they’ve carried Chester Wallace canvas bags built to fit two six-packs) you won’t find for a lower tag. While a different nearby store has Japanese denim for those whose wallets can indulge in jean dreams, Barket stocks Levi’s from the ’40s, ’50s, and ’60s, a tack that taps into the brand’s SF past and relates to it newer brands such as Woolrich and Gitman Tanner. Board progressives ditch their own tax measures

After failing to win support from the small business community for a measure that would have helped it and fearing a well-funded attack from large corporations, Board of Supervisors President David Chiu today made the motion to reject his business tax reform ballot measure.
Labor leaders have also raised concerns about not having enough resources to fight for several revenue measures on the November ballot, mostly because they are focused on approving a hotel tax increase, supporting progressive supervisorial candidates, and defeating Jeff Adachi’s measure to increase how much city employees pay for health care and into their pensions.
“There is still not consensus about whether this should move forward,” Chiu said of his measure, which also suffered from being complicated and not easy to explain in an election campaign. It would have created a more progressive payroll tax structure – increasing taxes on large corporations and lowering them on small businesses – and a commercial rent tax that also would have exempted small businesses, raising about $25 million for the city and creating hundreds of private sector jobs, according to the city’s Office of Economic Analysis.
But the fear among some progressives is that too many revenue proposals would hurt their individual chances, given that the ballot will now include a hotel tax increase, a real estate transfer tax on properties worth more than $5 million (which the board approved today on an 8-3 vote), a $10 local surcharge on vehicle license fees, and a parcel tax from the Community College District.
So Sup. Ross Mirkarimi today also abandoned his proposal to increase the city’s parking tax from 25 percent to 35 percent, which would have raised about $25 million per year. Both Chiu and Mirkarimi said their measures were good policy and would have raised desperately needed revenue, but they were bowing to political reality.
“We’re challenged by the practicality of mounting a fall campaign around these revenue measures,” Mirkarimi said at the meeting.
The board voted 10-1 to table both measures, with a dissenting vote by Sup. Chris Daly, who said, “I just disagree with that political analysis.” He said voters would consider the measures individually and “I don’t think disappearing a progressive payroll tax and progressive parking tax are going to help the real estate transfer tax.”

“The thing I love most in life is being a grandmother for social change.”

“If you mess up, you fess up — and then you fix it up.” That’s one of the motivational philosophies Sharen Hewitt, founder and executive director of the Community Leadership Academy and Emergency Response Project (CLAER) passes on to the people she works with. Her organization provides peer-to-peer empowerment and civic engagement programs as well as immediate crisis stabilization for victims of violence, helping them get the support they need. CLAER is based in Bayview, “but we serve the whole city, which unfortunately needs us more than ever,” she says.

A community leader and organizer for decades, Hewitt has been a critical and unyielding voice on housing, voter registration, education, employment, and political access issues. Her current focus has been on easing recent tensions between the African American and Asian American communities, weeding through the crowded field of candidates running for District 10 supervisor, and “insuring continuing dialogue about the development of sound public policy in the face of diminishing resources.”

“We celebrate diversity, and we try to raise the bar every day,” she says of CLAER. “San Francisco is the richest city in the richest state in the richest country in the world. It should be unlimited in its capacity to serve.”

“My favorite thing about the Bay Area is the coast along Route 1. It consistently amazes me.”

Food revolutionary Iso Rabins has organized the most intriguing — and fun — food events of the last year, expanding his health code-defying Underground Market far beyond its original berth in a Mission District home. But his keystone contribution to the Bay Area is his ability to communicate his vision of feeding communities without the agro-industrial machine — by recognizing the soil-generated bounty available to all of us if we know where to look.

“The way our society is structured right now didn’t seem like it paid attention to our local community. I think food is a great way to break through that,” Rabins says. His brainchild is forageSF, an organization that promotes hunting and gathering through wild food walks, eight-course foraged meals, and retail opportunities for foragers who spend days picking through the woods, fields, and coastlines. In the locavore-freegan vein, Rabins calls attention to a world beyond shrink-wrap and leaden government regulations. And his message is being eaten up by change-hungry SF. “I really think you can do business and help people at the same time,” he says.


 

2010 LOCAL HERO

KATHERINE PRIORE

“Something I love about San Francisco is being able to take yoga classes with the best teachers from here to Timbuktu.”

Eleven years ago Katherine Priore was an English teacher in Cincinnati’s public school system. After a particularly stressful day in the classroom, she finally took a close friend’s advice by attending said friend’s yoga class. Priore was instantly hooked. “I had never experienced such profound internal stillness. My stress was alleviated and the stream of anxious, teaching-related thoughts vanished in those 90 minutes.” It was this eureka moment that set Priore on the path to creating Headstand, an organization providing youth in economically disadvantaged areas with access to yoga.

The organization’s ultimate goal is to create a shift in the education system whereby the physical, emotional, and psychological health of students has the same importance as the academic skills they’re building. Headstand aims to do its part by integrating yoga into the curriculum, not just as an elective but as a requirement. Over the past two years, the organization has offered 1,400 yoga classes to 660 youths in the East Bay and San Francisco, and this fall it plans to bring Headstand to San Jose and Houston. With a slew of evidence that Headstand is positively affecting the lives of its students, all signs point to the early success of the program and to the potential it may just be starting to fulfill.

ERICA MCMATH SHEPPARD

“I love the Youth Speaks office. It doesn’t matter what I’m wearing or what I look like there.”

Odds were against Erica McMath Sheppard to be onstage at the Warfield this past March receiving thunderous applause from a sold-out crowd. But as McMath Sheppard’s powerful championship Youth Speaks Teen Poetry Slam spoken word performance put it, “I been helping myself my whole damn life .” Two things were clear under those bright lights: this woman has a story to tell, and the world’s going to hear it — no matter a difficult childhood, a disastrous trek through the foster care system, and eventual emancipation from her guardians at age 16.

In addition to her poetry laurels and longtime involvement with the Youth Speaks arts program, the Class of ’10 Leadership High graduate was senior class president, involved in the Black Student Union, and active in a slew of other extracurriculars — a record that earned her admission to Dillard University in New Orleans this fall. Does she consider herself a role model? “I’m not trying to be the voice for foster girls around the world,” she says. “But this is my dream.”

DONNA SACHET


“It’s not always easy to live in San Francisco — but it sure is a hell of a lot of fun.”

A constant presence on the queer and charitable scenes for years, Donna Sachet will go to any lengths to call attention to worthy causes — including rappelling down 38 stories of the Grand Hyatt San Francisco to raise money for the Special Olympics.

As a performer and sparkling personality, Sachet MCs the popular Sunday’s a Drag weekly brunch spectacular at Harry Denton’s Starlight Room, hosts the live coverage of the Pride parade on television, writes a society column for The Bay Area Reporter, and attends pretty much every charitable event worth attending. (You can always spot her by her impeccably tailored red outfits — she is, after all, Scarlet Empress XXX of San Francisco’s Imperial Court.) Her annual holiday Songs of the Season event and Pride Brunch fundraiser, along with her involvement with the Bare Chest Calendar benefiting the AIDS Emergency Fund, have raised thousands of needed dollars.

“You just have to do it,” she tells us of her unflagging energy. “I love my community. But even if it’s not particularly about your own community, we’re all in this together.”

VERNON DAVIS

“When I paint, I focus completely on what I’m doing and everything else fades.”

Freshly minted Pro Bowl superstar Vernon Davis has shown immense prowess on the football field since being drafted by the San Francisco 49ers in 2006. His career is on the upswing, and last season he tied the NFL all-time record for most touchdowns as a tight end. Davis’ success is the product of natural talent combined with drive and vision. He grew up in inner-city Washington, D.C., where a wise grandmother helped him dodge the environment’s potential pitfalls.

That same talent, drive, and vision extend beyond the goal posts into more esoteric realms. He’s an avid painter and seeks to be a role model for kids who might be afraid to explore their creativity. Earlier this year he launched the Vernon Davis Scholarship Fund, which will benefit a deserving Bay Area art student who would otherwise not be able to afford college. “I want to keep encouraging kids, especially in the inner city, to stay on track and pursue their dreams.”

JANE MARTIN


“I love being around a really vibrant queer and progressive community.”

On March 8, labor activist Jane Martin helped organize a flash mob in the crowded lobby of San Francisco’s Westin St. Francis Hotel. The purpose was to spread the word about a worker-called boycott of the hotel and urge tourists coming in for Pride to stay elsewhere. For five raucous and entertaining minutes, members of Pride at Work/HAVOQ, One Struggle One Fight, and the Brass Liberation Orchestra burst through the doors to sing, play, and dance to Lady Gaga’s hit “Bad Romance,” warning bewildered patrons not to “get caught in a bad hotel.”

The result: A collaborative effort of young and innovative labor leaders like Martin became a viral YouTube sensation, reaching hundreds of thousands of viewers. Martin has been joining with hotel workers in picket lines and organizing around queer economic justice issues in the Bay Area since 2001. She led picket lines at the Omni Hotel to decry the company’s move of locking out thousands of workers. “To ultimately win was really exciting,” she said. “When the hotels backed off, that was really inspiring.”

She recently joined 1,000 in staging a protest at the home of GOP gubernatorial candidate Meg Whitman as part of her organizing work with the California Nurses Association. And, as always with Martin, there’s more in the works.

“The Bay Area embodies the American spirit more than anyplace else in the country. You can be who you are without any fear.”

San Francisco is a city of immigrants, a place where generations of people have come — from all over the country and all over the world — for a fresh start in a welcoming environment. But Mayor Gavin Newsom put that tradition at risk this year when he directed law enforcement agents to start referring juveniles charged with crimes to federal immigration authorities. It’s been a disaster — in one case, a 13-year-old charged with stealing 46 cents was turned over to the feds, and he and his mom, who is married to a U.S. citizen, both faced deportation, breaking up a family.

San Francisco Sup. David Campos has led the battle to protect the city’s sanctuary policy — and has taken on the larger issue of immigration reform. An immigrant who arrived in the United States from Guatemala at 14 (and who couldn’t get federal financial aid to go to college because of his status), Campos isn’t afraid to challenge the growing nativist movement: “What’s made this country great,” he told us, “is taking talent from all over the world and integrating it into society. Now the current climate precludes that.”

*Alamar Pedro González-Rubio’s gorgeous Alamar ("to the sea") is set between landscapes (land and sea) and ways of telling (fiction and documentary). The bare frame of a plot places a young boy with his father and grandfather, Mayan fishermen working the Mexican Caribbean. The sweetness of this idyll is tempered by its provisional bounds: the boy will return to his mother in Rome at the end of his compressed experience of a father’s love. Every shot is earned: there are several in which the camera bucks with the boat, physically linked to the actors’ experience. The child is at an age of discovery, and González-Rubio channels this openness by fixing on the details of the fisher’s elegant way of life and the environmental contingencies of their home at sea. Dark House On a dare, a little girl enters the house "where the weird kids live," and finds a slew of children slaughtered, their murdering foster mother in suicidal death throes. Fourteen years later, Claire (Meghan Ory) is plagued by nightmares. Her therapist has the bright idea that she should "face the past" and unlock her repressed memories by visiting the house in question. Yeah, that’ll work. The arrival of high-tech spookhouse impresario Walston (Jeffrey Combs) provides a convenient plan of action, as he wants to hire her entire college acting class as live performers in a press preview of his latest creepy creation, a house of holographic horrors tastelessly located in the still-vacant site of that child massacre. Natch, before you can say "avenging evil spirit," the illusory frights turn into cast-winnowing real perils. This allows director-scenarist Darin Scott (who previously wrote 1995 horror omnibus Tales from the Hood) to toss in a bevy of genre familiars, from zombies to an axe-wielding scary clown. But Dark House isn’t meta-horror so much as a fairly ordinary slasher that’s more silly than it is self-aware (let alone scary). Meh. (1:26) Opera Plaza. (Harvey)

Dinner for Schmucks When he attracts favorable notice and a possible promotion from his corporate boss, Tim (Paul Rudd) is invited to an annual affair in which executives compete to see who can dig up the freakiest loser dweeb for everyone to snicker at. He literally runs into the perfect candidate: Barry (Steve Carrell), an IRS employee whose hobby is making elaborate tableaux with stuffed dead nice in tiny human clothes. He’s also the sort of person who, in trying to be helpful, inevitably wreaks havoc on the unlucky person being helped. Which means the 24 hours or so before the "Biggest Idiot" contest provide plenty of time for well-intentioned Barry to nearly destroy Tim’s relationship with a girlfriend (Stephanie Szostak), reunite him with Crazy Stalker Chick (Lucy Punch), and imperil his wooing of a multimillion-dollar account. Director Jay Roach (of the Austin Powers and Meet the Fockers series) has a full load of comedy talent on board here. So why are the results so tepid? This remake softens the bite of Francis Veber’s 1998 original French The Dinner Game by making Tim not a yuppie scumbag but a nice guy who just happens to have a jerk’s job (his company seizes ailing firms and liquidates them), and who doesn’t really want to expose hapless Barry to humiliation. But even with that satirical angle removed and a wider streak of sentimentality, it should cough up more laughs than it does. (1:50) (Harvey)

Farewell In Joyeux Noel (2005) director Christian Carion’s new drama, a KGB agent slips top-secret documents to a French businessman, hoping to bring about the end of the Cold War. Fun fact: Fred Ward plays Reagan. (1:53) Embarcadero, Shattuck, Smith Rafael.

*Kisses Sweet as a lingering caress or a smooch swiftly snatched, Kisses is besotted with the feel, lights, and ambiance of Dublin and the sensation of being young, free, and all too ready to plunge into the mysteries of adulthood. Next-door neighbors living on the outskirts of the big city, Kylie (Kelly O’Neill) and Dylan (Shane Curry) have a few things in common: they’re both children forced to grow up far faster than they like. When Dylan strikes back at his abusive father, the two flee, vowing never to return. Their goal is to find Dylan’s older brother, who ran from their father’s beatings long ago. And through their street-wise but still innocent eyes — and Kisses‘ gradual, graceful transition from black and white to color — Dublin takes on a subtle magic, one that darkens as the night and its dangers progress. To his credit, director and writer Lance Daly avoids striving for epic statements with Kisses. Rather, he keeps his unashamedly romantic focus tight on the moment and his two riveting leads, coaxing a wonderful performance in particular from O’Neill, whose angelic contenance, giving-as-good-as-it-gets lip, and bulldog feistiness stays with you long after Kisses‘ tender touch has faded. *Orlando The director Sally Potter recently revealed during a panel discussion in New York that she was once told, "There’s only one golden rule: nobody should ever try to adapt Virginia Woolf!" Eighteen years later Potter’s fantastic Orlando (1992) stands as proof to the contrary. As whip smart and thick with history and allusion as Woolf’s 1928 "biography" of its titular time-traveling, gender-bending hero, Orlando feels less like an adaptation of its source material than a collaboration with it. While the sumptuous costumes and lush production design certainly do their part, Woolf’s sharp humor and nuanced observations about art, nature, gender, and, well, nearly everything else, truly come alive thanks to Tilda Swinton’s performance in the title role. With her androgynous features, dry delivery, and winking, direct addresses to the camera, Swinton carries Orlando‘s journey from male consort to Queen Elizabeth (Quentin Crisp, in a brilliant bit of casting that would be his last onscreen appearance), to the most desired woman in 18th century London, to modern day published author and mother, with the practiced ease of a prima ballerina. Orlando elevated the flame-haired actor from Derek Jarman-muse to full-blown art house star. Come and see why. (1:33) Lumiere, Shattuck. (Sussman)

Winnebago Man This documentary tells the strange story of Jack Rebney, a YouTube sensation (thanks to a cussin’-tastic RV commercial outtake) who has no idea of his viral fame. (1:15) Shattuck.

ONGOING

Agora There’s a good movie somewhere in Agora, but finding it would require severe editing. It’s not that the film is too long, though it does drag in stretches. The problem is that there are too many stories being told: Hypatia of Alexandria, the central figure, only emerges as the focus well into the film. Meanwhile, there’s Davus (Max Minghella), the slave boy in love with her; Orestes (Oscar Isaac), the student who tries to win her affection; Synesius (Rupert Evans), the devout Christian. We jump from character to character and plot to plot — the conflict between the pagans and the Christians, the conflict between the Christians and the Jews, and Hypatia’s studies in astronomy. Agora is so scattered that by the time it reaches its tragic conclusion — only a spoiler if you haven’t already Googled Hypatia — there’s little room to breathe, let alone grieve. While Hypatia herself is a fascinating subject, Agora is weighed down by all the stories it’s intent on cramming in. (2:06) (Peitzman)

*Anton Chekhov’s The Duel Conformity vs. freedom, small-town whispers vs. the heavy hand of the law — Georgian director Dover Kosashvili successfully teases out some of the tensions in the Anton Chekhov novella, encapsulating the provincial pressures brought to bear on deviants and nonconformists during a steamy summer in a seaside resort town in the Caucasus. Dissolute civil servant and would-be intellectual Laevsky (Andrew Scott) is in the bind, as he gripes to the town doctor Samoylenko (Niall Buggy). Laevsky has everything he wants: he’s coaxed the creamy, married Nadya (Fiona Glascott) into living with him openly, yet now that her husband has died, he desires nothing more than to be free of her. In the meantime upstanding zoologist Von Koren (Tobias Menzies) simmers in the background, gaging Laevsky’s social mores and practically oozing contempt. Matters come to a head as Laevsky begs a loan from Samoylenko to escape his ripening paramour, who is also beginning to feel the gracious perimeters of the town closing in around her. From the buttons-and-bows millinery details to the oppressive dark wood furnishings, Kosashvili even-handedly builds a compelling Victorian-era mise en scene that seems to perfectly evoke the Chekhov’s milieu — it’s only when the title entanglement comes to pass that we finally see which side he’s on. Beetle Queen Conquers Tokyo Opening with the humid buzz of crickets and the probings of bug aficionados in the thick of a forest, first-time documentarian Jessica Oreck puts Japan’s fascination with insects under the microscope. Preferring to let the images and interview subjects speak for themselves, she turns a lens to young children who clamor to buy sleek, shiny, obsidian beetles, as well as the giant big city gatherings of insect collectors — events that likely are less than familiar to western audiences. Oreck’s intent is to get at the ineffable attraction behind such astonishing sales as that of a single beetle for $90,000 not so long ago, and to that end, she weaves in looks at insect literature and art, visits to Buddhist temples, and historical factoids about, for instance, the first cricket-selling business in the early 1800s. (1:30) (Chun)

Breathless (1:30)

*City Island The Rizzo family of City Island, N.Y. — a tiny atoll associated historically with fishing and jurisdictionally with the Bronx — have reached a state where their primary interactions consist of sniping, yelling, and storming out of rooms. These storm clouds operate as cover for the secrets they’re all busy keeping from one another. Correctional officer Vince (Andy Garcia) pretends he’s got frequent poker nights so he can skulk off to his true shameful indulgence: a Manhattan acting class. Perpetually fuming spouse Joyce (Julianna Margulies) assumes he’s having an affair. Daughter Vivian (Dominik García-Lorido) has dropped out of school to work at a strip joint, while the world class-sarcasms of teenager Vinnie (Ezra Miller) deflect attention from his own hidden life as an aspiring chubby chaser. All this (plus everyone’s sneaky cigarette habit) is nothing, however, compared to Vince’s really big secret: he conceived and abandoned a "love child" before marrying, and said guilty issue has just turned up as a 24-year-old car thief on his cell block. Writer-director Raymond De Felitta made a couple other features in the last 15 years, none widely seen; if this latest is typical, we need more of him, more often. Perfectly cast, City Island is farcical without being cartoonish, howl-inducing without lowering your brain-cell count. It’s arguably a better, less self-conscious slice of dysfunctional family absurdism than Little Miss Sunshine (2006) — complete with an Alan Arkin more inspired in his one big scene here than in all of that film’s Oscar-winning performance. Cyrus It’s tempting to label Mark and Jay Duplass’ Cyrus as "mumblecore goes mainstream." Yes, the mumblecore elements are all there: plentiful moments of awkward humiliation, characters fumbling verbally and sometimes physically in desperate attempts to establish emotional connections, and a meandering, character-driven plot, in the sense that the characters themselves possess precious little drive. The addition of bona fide indie movie stars John C. Reilly, Catherine Keener, and Marisa Tomei — not to mention Hollywood’s chubby-funny guy du jour, Jonah Hill — could lead some to believe that the DIY-loving Duplass brothers (2005’s The Puffy Chair, 2008’s Baghead) have gone from slacker disciples of John Cassavetes (informally known as "Slackavetes") to worshippers at the slickly profane (with a heart) altar of Judd Apatow. But despite the presence of Apatow protégé Hill (2007’s Superbad) in the title role, Cyrus steers clear of crowd-pleasing bombast, instead favoring small, relatively naturalistic moments. That is to say, not much actually happens. Mumblecore? More or less. Mainstream? Not exactly. Despite playing a character with some serious psychological issues, Hill comes off as likeable. Unfortunately the movie is neither as broadly comic nor as emotionally poignant as it needs to be — the two opposing forces seem to cancel each other out like acids and bases. (1:32) (Devereaux)

Despicable Me Judging from the adorable, booty-shaking, highly merchandisable charm of its sunny-yellow Percocet-like minions, Despicable Me‘s makers have more than a few fond memories of the California Raisins. That gives you an idea of the 30-second attention-span level at work here. Thanks to Pixar and company, our expectations for animated features are high, but despite the single lob at Lehman Brothers aimed toward the grown-ups, the humor here is pitched straight at the eight and younger crowd: from the mugging, child-like minions to the all-in-good-fun, slightly quease-inducing 3-D roller-coaster ride. Gru (Steve Carell) is Despicable‘s also-ran supervillain — a bit too old and too unoriginal for a game that’s been rigged in the favor of the youthful, annoyingly perky Vector (Jason Segel), who’s managed to swipe the Giza Pyramids and become the world’s number one bad dude. When Vector steals away the crucial shrink ray needed for Gru’s plot to thieve the moon, the latter pulls out the big guns: three adorable orphans who have managed to penetrate Vector’s defenses with their fund-raising cookie sales. It turns out kids have their own insidiously heart-warming way of wrecking havoc on one’s well-laid plans. Filmmakers Pierre Coffin and Chris Renaud do their best to exploit the 3-D medium, but Avatar (2009) this is not. Nor will many adults be able to withstand the onslaught of cute undertaken by all those raisins, I mean, minions. (1:35) (Chun)

*Exit Through the Gift Shop Exit Through the Gift Shop is not a film about the elusive graffiti-cum-conceptual artist and merry prankster known as Banksy, even though he takes up a good chunk of this sly and by-no-means impartial documentary and is listed as its director. Rather, as he informs us — voice electronically altered, face hidden in shadow — in the film’s opening minutes, the film’s real subject is one Thierry Guetta, a French expat living in LA whose hangdog eyes, squat stature, and propensity for mutton chops and polyester could pass him off as Ron Jeremy’s long lost twin. Unlike Jeremy, Guetta is not blessed with any prodigious natural talent to propel him to stardom, save for a compulsion to videotape every waking minute of his life (roughly 80 percent of the footage in Exit is Guetta’s) and a knack for being in the right place at the right time. When Guetta is introduced by his tagger cousin to a pre-Obamatized Shepard Fairey in 2007, he realizes his true calling: to make a documentary about the street art scene that was then only starting to get mainstream attention. Enter Banksy, who, at first, is Guetta’s ultimate quarry. Eventually, the two become chummy, with Guetta acting as lookout and documenter for the artist just as the art market starts clambering for its piece of, "the Scarlet Pimpernel of street art," as one headline dubs him. When, at about three quarters of the way in, Guetta, following Banksy’s casual suggestion, drops his camcorder and tries his hand at making street art, Exit becomes a very different beast. Guetta’s flashy debut as Mr. Brainwash is as obscenely successful as his "art" is terribly unimaginative — much to the chagrin of his former documentary subjects. But Guetta is no Eve Harrington and Banksy, who has the last laugh here, gives him plenty of rope with which to truss himself. Is Mr. Brainwash really the ridiculous and inevitable terminus of street art’s runaway mainstream success (which, it must be said, Banksy has handsomely profited from)? That question begs another: with friends like Banksy, who needs enemies? (1:27) Roxie. (Sussman)

Get Him to the Greek At this point movie execs can throw producer Judd Apatow’s name on the marquee of a film and it’s a guaranteed blockbuster. It’s hard to say whether this Forgetting Sarah Marshall (2008) spin-off benefits from the Apatow sign of approval or if it would be better off standing on its own, but it definitely doesn’t benefit from comparisons to its predecessor. Russell Brand returns as the British rock star Aldous Snow, and Jonah Hill, playing a different character this time, is given the task of chaperoning the uncooperative Snow from London to LA in 48 hours. Despite a great cast, including a surprisingly animated P. Diddy, the story is pretty bland and can’t match the blend of drama and comedy that Marshall achieved. Of course, none of that matters because the movie execs are right: if you like Apatow’s brand of humor, you’re going to have a good time anyway. (1:49) (Peter Galvin)

*The Girl Who Played With Fire Lisbeth Salander is cooler than you are. The heroine of Stieg Larsson’s bestselling book series is fierce, mysterious, and utterly captivating: in the movie adaptations, she’s perfectly realized by Noomi Rapace, who has the power to transform Lisbeth from literary hero to film icon. Rapace first impressed audiences in The Girl With the Dragon Tattoo (2009), a faithful adaptation of Larsson’s premiere novel, and she returns as Lisbeth in The Girl Who Played With Fire. The sequel, as is often the case, isn’t quite on par with the original, but it’s still a page-to-screen success. And while the first film spent equal time on journalist Mikael Blomkvist (Michael Nyqvist), The Girl Who Played With Fire is almost entirely Lisbeth’s story. Sure, there’s more to the movie than the hacker-turned-sleuth — and the actor who plays her — but she carries the film. Rapace is Lisbeth; Lisbeth is Rapace. I’d watch both in anything. *The Girl With the Dragon Tattoo By the time the first of Stieg Larsson’s so-called "Millennium" books had been published anywhere, the series already had an unhappy ending: he died (in 2004). The following year, The Girl With the Dragon Tattoo became a Swedish, then eventually international sensation, its sequels following suit. The books are addicting, to say the least; despite their essential crime-mystery-thriller nature, they don’t require putting your ear for writing of some literary value on sleep mode. Now the first of three adaptive features shot back-to-back has reached U.S. screens. (Sorry to say, yes, a Hollywood remake is already in the works — but let’s hope that’s years away.) Even at two-and-a-half hours, this Girl With the Dragon Tattoo by necessity must do some major truncating to pack in the essentials of a very long, very plotty novel. Still, all but the nitpickingest fans will be fairly satisfied, while virgins will have the benefit of not knowing what’s going to happen and getting scared accordingly. Soon facing jail after losing a libel suit brought against him by a shady corporate tycoon, leftie journalist Mikael Blomkvist (Michael Nyqvist) gets a curious private offer to probe the disappearance 40 years earlier of a teenage girl. This entangles him with an eccentric wealthy family and their many closet skeletons (including Nazi sympathies) — as well as dragon-tattooed Lisbeth Salander (Noomi Rapace), androgynous loner, 24-year-old court ward, investigative researcher, and skillful hacker. Director Niels Arden Oplev and his scenarists do a workmanlike job — one more organizational than interpretive, a faithful transcription without much style or personality all its own. Nonetheless, Larsson’s narrative engine kicks in early and hauls you right along to the depot. (2:32) Smith Rafael. (Harvey)

*Great Directors Sussing taste in movies isn’t always as easy as perusing a shelf — not everyone necessarily cares to watch repeatedly even the films they esteem most. (Of course 1941’s Citizen Kane is brilliant, but do I own that? Nix. But 2000’s Dude, Where’s My Car? Yup.) Thus Angela Ismailos’ new documentary Great Directors is as interesting for what it reveals about the curator as for insights from "great" filmmakers themselves. Ismailos has tony taste: good if idiosyncratic, the kind you can respect yet argue with. She’s a real cineaste. And a narcissist, falling into that realm of filmmakers who make movies about other people yet incessantly insert themselves into the frame. Still, there have been far worse offenders in the realm of Gratuitous Me: The Documentary, and Ismailos chooses her subjects — plus filmic excerpts — with beguiling intelligence. The interviewees are very articulate. Are all "great"? Well, it’s hard to argue against Bernardo Bertolucci and David Lynch. Richard Linklater and Todd Haynes are inspired next-generation American choices. With John Sayles we enter the land of good intentions. Likewise Ken Loach and Stephen Frears. The jury’s still out on Catherine Breillat, while one truly odd choice is Liliana Cavani (1974’s S–M Nazi romance The Night Porter); offering contrast is Agnès Varda, whose puckish cinema is hobbit-like in its denial of sex. Several participants share tales of production travails, like Lynch claiming "It’s beautiful to have a great failure" (i.e., 1984’s Dune) since it freed him to make smaller, more personal projects like next-stop Blue Velvet (1986). Preening and adoring her idols in camera view, Ismailos flashes her good taste around. This would be more annoying if her taste wasn’t, in fact, pretty choice. (1:26) Opera Plaza, Shattuck. (Harvey)

Grown Ups In order of star power, Grown Ups casts Adam Sandler, Kevin James, Chris Rock, Rob Schneider, and David Spade as five fortysomething friends who reunite to attend the funeral of their high school basketball coach, and play catch-up over a long weekend together at a cabin by the lake. If you’re expecting five of America’s biggest comedy stars to form like Voltron and make the most hilarious movie of the year, you’ve got a sad day coming. Grown Ups is never the sum of its parts, it’s about on par with Sandler’s other producing/starring affairs, and probably features a lot of the same jokes. People fall in poop and little kids say cute things designed to make audiences awww, but history has shown that’s exactly what a popcorn viewer is looking for. By these standards, Grown Ups is a perfectly summer-y movie. (1:42) (Galvin)

*I Am Love I Am Love opens in a chilly, Christmastime Milan and deliberately warms in tandem with its characters. Members of the blue-blood Recchi family are content hosting lavish parties and gossiping about one another, none more than the matriarch Emma (Tilda Swinton). But when prodigal son Edoardo befriends a local chef, Emma finds herself taken by both the chef’s food and his everyman personality, and is reminded of her poor Soviet upbringing. The courtship that follows is familiar on paper, but director Luca Guadagnino lenses with a strong style and small scenes acquire a distinct energy through careful editing and John Adams’ unpredictable score. Swinton portrays Emma’s unraveling with the same gritty gusto she brought to Julia (2008), and her commitment to the role recognizes few boundaries. You’ve probably seen this story before, but it has rarely been this powerful. (2:00) (Galvin)

Inception As my movie going companion pointed out, "Christopher Nolan must’ve shit a brick when he saw Shutter Island." In Nolan’s Inception, as in Shutter Island, Leonardo DiCaprio is a troubled soul trapped in a world of mind-fuckery, with a tragic-vengeful wife (here, Marion Cotillard) and even some long-lost kids looming in his thoughts at all times. But Inception, about a team of corporate spies who infiltrate dreams to steal information and implant ideas, owes just as much to The Matrix (1999), Eternal Sunshine of the Spotless Mind (2004), and probably a James Bond flick or two. Familiar though it may feel, at least Inception is based on a creative idea — how many movies, much less summer blockbusters, actually require viewer brain power? If its complex house-of-cards plot (dreams within dreams within dreams) can’t quite withstand nit-picking, its action sequences are confidently staged and expertly directed, including a standout sequence involving a zero-gravity fist fight and elevator ride. Though it’s hardly genius — and Leo-recycle aside — Inception is worth it, if you don’t mind your puzzle missing a few pieces. (2:30) (Eddy)

*Joan Rivers: A Piece of Work Whether you’re a fan of its subject or not, Ricki Stern and Annie Sundberg’s documentary is an absorbing look at the business of entertainment, a demanding treadmill that fame doesn’t really make any easier. At 75, comedian Rivers has four decades in the spotlight behind her. Yet despite a high Q rating she finds it difficult to get the top-ranked gigs, no matter that as a workaholic who’ll take anything she could scarcely be more available. Funny onstage (and a lot ruder than on TV), she’s very, very focused off-, dismissive of being called a "trailblazer" when she’s still actively competing with those whose women comics trail she blazed for today’s hot TV guest spot or whatever. Anyone seeking a thorough career overview will have to look elsewhere; this vérité year-in-the-life portrait is, like the lady herself, entertainingly and quite fiercely focused on the here-and-now. John Rabe John Rabe (Ulrich Tukur) was the Oskar Schindler of Nanking: A man who, under discreetly opportunist pretenses, attempted to keep the Chinese in a safety zone from the Japanese in the late 30s. Steve Buscemi plays Robert Wilson, a surly American doctor. He’s to Tukur as Ben Kingsley was to Liam Neeson in 1993’s Schindler’s List, but without the nuance or iconic chemistry. Tukur is understated, bordering on uninteresting, and Buscemi is just over-the-top. Unlike Spielberg’s film, John Rabe grants us little access to the stories of civilians. The film is so preoccupied with people of power and those like Rabe, couched in a world of privilege, that the film lacks an emotional, human center. It’s impossible to feel much of anything because we’re never asked to feel, nor are we ever asked to endure any especially difficult scenes. Even the occasional rain of hellfire isn’t as wallop-packing as it ought to be. (2:14) (Ryan Lattanzio)

*The Kids Are All Right In many ways, The Kids Are All Right is a straightforward family dramedy: it’s about parents trying to do what’s best for their children and struggling to keep their relationship together. But it’s also a film in which Jules (Julianne Moore) goes down on Nic (Annette Bening) while they’re watching gay porn. Director Lisa Cholodenko (1998’s High Art) co-wrote the script (with Stuart Blumberg), and the film’s blend between mainstream and queer is part of what makes Kids such an important — not to mention enjoyable — film. Despite presenting issues that might be contentious to large portions of the country, the movie maintains an approachability that’s often lacking in queer cinema. Of course, being in the gay mecca of the Bay Area skews things significantly — most locals wouldn’t bat an eye at Kids, which has Nic and Jules’ children inviting their biological father ("the sperm donor," played by Mark Ruffalo) into their lives. But for those outside the liberal bubble, the idea of a nontraditional family might be more eye-opening. It’s not a message movie, but Kids may still change minds. And even if it doesn’t, the film is a success that works chiefly because it isn’t heavy-handed. It refuses to take itself too seriously. At its best, Kids is laugh-out-loud funny, handling the heaviest of issues with grace and humor. (1:47) (Peitzman)

*Knight and Day A Bourne-again Vanilla Sky (2001)? Considerably better than that embarrassingly silly stateside remake, though not quite as fulfilling as director James Mangold’s 3:10 to Yuma (2007) rework, this action caper played for yuks still isn’t the most original article in the cineplex. But coasting on the dazzling Cheshire grins of its stars, Tom Cruise and Cameron Diaz, reunited for the first time since Sky, you can just make out the birth of a beautiful new franchise. Everygirl June Havens (Diaz) is on her way to her sister’s wedding when she collides-cute at the airport with Roy Miller (Cruise). After killing the passengers and pilots on their plane, he literally sweeps her off her feet — thanks to some potent drugs. Picture a would-be Bond girl dragged against a spy-vs.-spy thriller semi-against-her-will — grappling with the subtextual anxiety rushing beneath all brief romantic encounters as well as some very justifiable survival fears. Can June overcome her trust issues? Is Roy the man of her dreams — or nightmares? Mangold and company miss a few opportunities to have more fun with those barely teased out ideas, and the polished, adult-yet-far-from-knowing charisma of the leads doesn’t quite live up to sophisticated interplay of Cary Grant and Grace Kelly, or even the down-home fun of Burt Reynolds and Sally Field, but it’s substantial enough for Knight and Day to coast on, for about 90 minutes tops. The Last Airbender There must be some M. Night Shyamalan fans out there. How else does one explain the fact that he keeps making movies? And yet, most of his post-Sixth Sense (1999) work has ranged from forgettable to downright reviled. His latest disaster is sure to fall into the latter category: in The Last Airbender, he takes a much-loved Nickelodeon cartoon and transforms it into an awkwardly paced, poorly acted mess. Woefully miscast Noah Ringer stars as Aang, the avatar with the power to end the Fire Nation’s dominion. Along with his friends, siblings Sokka (Jackson Rathbone) and Katara (Nicola Peltz), Aang must — oh, just watch the damn show. For newcomers, the film is as confusing as Shyamalan’s equally self-indulgent Lady in the Water (2006). For fans of the TV show, The Last Airbender is nearly unbearable, condensing the entire first season into one film by removing the humor, the heart, and the complexity of the characters. There’s no twist here — we expect Shyamalan to disappoint, and he does. (1:34) (Peitzman)

*Let It Rain Well-known feminist author Agathe Villanova (writer-director Agnès Jaoui) is taking a rare break from her busy Paris life, visiting her hometown to see family, vacation with boyfriend Antoine (Frédéric Pierrot), and do a little stumping for her nascent political career. But despite the ever-picturesque French countryside as background, all is not harmonious. Antoine complains Agathe’s workaholism (among other things) is killing their relationship, particularly once she agrees to be time-consumingly interviewed for film about "successful women" by shambling documentarian Michel (coscenarist Jean-Pierre Bacri) and local Karim (Jamel Debbouze). Her married-with-children sister Florence (Pascale Arbillot) is having a secret affair with Michel, but seems more focused on old resentments springing from Agathe being their late mother’s favorite. Karim — son of the family’s longtime housekeeper (Mimouna Hadji) — bears his own grudge against the clan and brusque, officious Agathe in particular. Being happily wed, he’s further bothered at his hotel day job by his attraction to co-worker Aurélie (Florence Loiret-Caille). These various conflicts simmer, then boil over as the documentary shooting goes from bumbling to disastrous. In 2004, Jaoui delivered a pretty near perfect Gallic ensemble seriocomedy in Look at Me. This isn’t quite that good. Still, her seemingly effortless skill at managing complex character dynamics, eliciting expert performances (including her own), and weaving it all together with insouciant panache makes this a real pleasure. The problem with Agnès Jaoui: she’s so good it chafes that (acting-only gigs aside) she’s made just three films in ten years. Pick it up, girl! (1:39) Smith Rafael. (Harvey)

The Lottery (1:21) Roxie.

Micmacs An urge to baby-talk at the screen underlines what is wrong with Jean-Pierre Jeunet’s new film: it is like a precocious child all too aware how to work a room, reprising adorable past behaviors with pushy determination and no remaining spontaneity whatsoever. There will be cooing. There will be clucking. But there will also a few viewers rolling their eyes, thinking "This kid rides my last nerve." It’s easy to understand why Jeunet’s movies (including 2001’s Amélie) are so beloved, doubtless by many previously allergic to subtitles. (Of course, few filmmakers need dialogue less.) They are eye-candy, and brain-candy too: fantastical, hyper, exotic, appealing to the child within but with dark streaks, byzantine of plot yet requiring no close narrative attention at all. The artistry and craftsmanship are unmissable, no ingenious design or whimsical detail left unemphasized. In Micmacs, hero Bazil (Dany Boon) is a lovable misfit who lost his father to an Algerian landmine, then loses his own job and home when he’s brain-injured by a stray bullet. He falls in with a crazy coterie of lovable misfits who live underground, make wacky contraptions from junk, and each have their own special, not-quite-super "power." They help him wreak elaborate, fanciful revenge on the greedy arms manufacturers (André Dussollier, Nicolas Marié) behind his misfortunes, as well as various human rights-y global ones. So there’s a message here, couched in fun. But the effect is rather like a birthday clown begging funds for Darfur — or Robert Benigni’s dreaded Life is Beautiful (1997), good intentions coming off a bit hubristic, even distasteful. Predators Anyone who claims to be disappointed by Predators has clearly never seen parts one and two in the series; all three are straight B-movie affairs (though 1990’s Predator 2 takes everything oh-so-slightly over the top. Gary Busey’ll do that). And if you’ve seen either of the recent Predator-versus-Alien flicks, Predators should feel like a masterpiece. Nimród Antal directs under the banner of Robert Rodriguez’s production company, which explains the presence of Danny "Machete" Trejo in the cast. Adrien Brody stashes his Oscar in a safe place to star as Royce, a well-armed mercenary who awakes to find himself in free fall, plummeting into a strange jungle along with other elite-forces types (including Brazilian Alice Braga, playing an Israeli soldier). It doesn’t take long before Royce realizes that "this is a game preserve, and we’re the game." I wish Predators had allowed itself to have a little more fun with its uniquely skilled characters (the yakuza guy does have a nice, if culturally-stereotyped, swordplay scene); there’s also an underdeveloped "plot twist" involving the presence of the decidedly un-badass Topher Grace among the human prey. But all is forgiven when Laurence Fishburne turns up as Crazy Old Dude Who’s Been Hiding Out With Predators a Little Too Long. Fishburne’s presence also adds to the heart-of-darkness vibe the movie seems vaguely interested in conveying. (1:51) (Eddy)

Ramona and Beezus (1:44)

*Restrepo Starting mid-’07, journalists-filmmakers Tim Hetherington and Sebastian Junger spent some 15 months off and on embedded with a U.S. Army platoon in Afghanistan’s Korengal Valley, a Taliban stronghold with steep, mountainous terrain that could hardly be more advantageous for snipers. Particularly once a second, even more isolated outpost is built, the soldiers’ days are fraught with tension, whether they’re ordered out into the open on a mission or staying put under frequent fire. Strictly vérité, with no political commentary overt or otherwise, the documentary could be (and has been) faulted for not having enough of a "narrative arc" — as if life often does, particularly under such extreme circumstances. But it’s harrowingly immediate (the filmmakers themselves often have to dive for cover) and revelatory as a glimpse not just of active warfare, but of the near-impossible challenges particular to foreign armed forces trying to make any kind of "progress" in Afghanistan. Salt Angelina Jolie channels the existential crisis of Jason Bourne and the DIY spirit of MacGyver in a film positing that America’s most pressing concern is extant Russian cold warriors, who are plotting to reestablish their country’s pre-glasnost glory via nuclear holocaust and a Dark Angel–style army of spy kids. Jolie plays CIA agent Evelyn Salt, a woman who can stymie the top-shelf surveillance system at work using her undergarments and fashion a shoulder-mounted rocket out of interrogation-room furniture and cleaning supplies. These talents surface after Salt is accused of being a Russian operative in league with the aforementioned disturbers of the new world order and takes flight, with her agency coworkers (Liev Schreiber and Chiwetel Ejiofor) in hot pursuit. What ensues is a vicious and confounding assault on the highest levels of the U.S. government, most known rules of logic, and the viewer’s patience and powers of suspending disbelief. Salt’s off-the-ranch maneuverings are moderately engaging, particularly in the first leg of the chase, but clunky expository flashbacks, B-movie-grade dialogue, and an absurd plotline slow the momentum considerably. The Secret in Their Eyes (2:07)

The Sorcerer’s Apprentice Socially awkward science nerd Dave (Jay Baruchel) toils away on his suspiciously elaborate NYU physics project, unaware that he’s about to have a Harry Potter-style moment of awakening. Enter Balthazar (Nicolas Cage), a centuries-old, steampunky sorcerer who believes Dave to be "the Prime Merlinian" — i.e., the greatest conjurer since Merlin himself. (Literally) rising from ashes to provide conflict are fellow sorcerers Horvath (Alfred Molina) and Morgana (Alice Krige); signing on for romantic-interest purposes are Monica Bellucci and newcomer Teresa Palmer. The Sorcerer’s Apprentice spins off Disney classic Fantasia (1940) in only the loosest sense, though there is a scene of dancing brooms. The bland Baruchel’s rise to fame continues to mystify, but at least Cage and Molina seem to be having a blast exchanging insults and zapping each other around. (1:43) (Eddy)

South of the Border After a prolific career of dramatic films steeped in political commentary, Oliver Stone drops the pretext. South of the Border is his Michael Moore moment, a chance for the filmmaker to make a direct and focused documentary in which his bias is readily apparent. Stone travels to South American nations and meets with their political leaders, men and women — including Hugo Chávez, Evo Morales, and Rafael Correa — who have long been considered enemies of the United States. His goal is to show that they are not ruthless dictators but rather democratically elected representatives of their country, cast in a negative light by a mainstream media with ulterior motives. Stone’s rapport with these politicians is intimate: at one point, he plays soccer with Morales. Even if you’re skeptical of his assertions, you can at least appreciate the unique perspective South of the Border offers. As a film, it’s somewhat slipshod, not nearly as glossy as a Moore production. But provided you’re willing to fill in the blanks, it’s a captivating and well-intentioned endeavor. (1:18) (Peitzman)

*Stonewall Uprising On the night of June 28, 1969, police embarked on what they thought would be a routine raid on a gay bar in New York’s Greenwich Village, the sleazy, Mafia-run Stonewall Inn. The ensuing three days of rioting — during which mostly young men and drag queens accustomed to being marginalized and hauled off to jail stood their ground and fought back — became what historian Lillian Faderman has called "the shot heard round the world" for LGBT activism: a spontaneous expression of street-level outrage that fueled the birth of a movement. Kate Davis and David Heilbroner’s solid documentary Stonewall Uprising takes a "just the facts, ma’am" approach to this historic flashpoint that makes for an information-packed, if at times dry, 80 minutes. Working around the paucity of photographic documentation of the actual riots (itself a testament to the marginalization of homosexuality in the late 1960s), Davis and Heilbroner make extensive use of period news footage and photography, reenactments, and most important, the first-person testimonies of who those who witnessed and participated in what one interviewee terms "our Rosa Parks moment." The filmmakers’ contextual groundwork is as impressive for its archival research as it is repetitive in its message: pre-Stonewall life was hell. The documentary becomes more nuanced as it zeros in on reconstructing the first night of rioting via eyewitness accounts. (1:22) (Sussman)

*Toy Story 3 You’ve got a friend in Pixar. We all do. The animation studio just can’t seem to make a bad movie — even at its relative worst, a Pixar film is still worlds better than most of what Hollywood churns out. Luckily, Toy Story 3 is far from the worst: it’s actually one of Pixar’s most enjoyable and poignant films yet. Waiting 11 years after the release of Toy Story 2 was, in fact, a stroke of genius, in that it amplifies the nostalgia that runs through so many of the studio’s releases. The kids who were raised on Toy Story and its first sequel have now grown up, gone to college, and, presumably, abandoned their toys. For these twentysomethings, myself included, Toy Story 3 is a uniquely satisfying and heartbreaking experience. While the film itself may not be the instant classic that WALL-E (2008) was, it’s near flawless regardless of a viewer’s age. Warm, funny, and emotionally devastating—it’s Pixar as it should be. The Twilight Saga: Eclipse The only person more bored by the Twilight franchise than I am is Kristen Stewart. In Eclipse, the third installment of the film series, she mopes her way through further adventures with creepily obsessive vampire Edward (Robert Pattinson). Look, you’re either sold on this star-crossed love story or you’re not, and it’s clear which camp I fall into. Besides, Eclipse is at least better than New Moon, the dreadful Twilight film that preceded it last year. But the story is still ponderous and predictable — Eclipse sets up a conflict and then quickly resolves it, just so it can spend more time on the Bella-Edward-Jacob love triangle. (As if we don’t know how that ends.) Then there’s the unfortunate anti-sex subtext: carnal relations are cast as dirty, wrong, and soul-destroying. I’m not saying we should be encouraging all teenagers to have sex, but that doesn’t mean we should make them feel ashamed of their desires. And what parent would approve of Eclipse‘s conclusion? Marrying your first boyfriend at 18 — not always the best move. (2:04) (Peitzman)

*Winter’s Bone Winter’s Bone has already won awards at the Berlin International Film Festival and the Sundance Film Festival, but it’s the kind of downbeat, low-key, quiet film that may elude larger audiences (and, as these things go, Oscar voters). Like Andrea Arnold’s recent Fish Tank, it tells the story of a teenage girl who draws on unlikely reserves of toughness to navigate an unstable family life amid less-than-ideal economic circumstances. And it’s also directed by a woman: Debra Granik, whose previous feature, 2004’s Down to the Bone, starred Vera Farmiga (2009’s Up in the Air) as a checkout clerk trying to balance two kids and a secret coke habit.

Drugs also figure into the plot of the harrowing Winter’s Bone, though its protagonist, Ree Dolly (Jennifer Lawrence), is faced with a different set of circumstances: her meth head father has jumped bail, leaving the family’s humble mountain home as collateral; the two kids at stake are her younger siblings. With no resources other than her own tenacity, Ree strikes out into her rural Missouri community, seeking information from relatives who clearly know where her father is — but ain’t sayin’ a word. It’s a journey fraught with menace, shot with an eye for near-documentary realism and an appreciation for slow-burn suspense; Lawrence anchors a solid cast with her own powerful performance. Who says American independent film is dead? (1:40) (Eddy)

City Hall standoff

Backroom politics, vote-trading, threats, and tricky legislative maneuvering marked — some would say marred — the approval of the city’s 2010-11 budget and a package of fall ballot measures.

For weeks, Mayor Gavin Newsom had been threatening to simply not spend the roughly $42 million in budgetary add-backs the supervisors had approved July 1, mostly for public health and social services, unless they agreed to withdraw unrelated November ballot measures that Newsom opposes (see "Bad faith," July 14).

The board’s July 20 meeting included a flurry of last-minute maneuvers interrupted by an hours-long recess during which Newsom, Board President David Chiu, and their representatives negotiated a deal that was bristled at by progressive supervisors and fiscal conservative Sup. Sean Elsbernd.

Ideological opposites Elsbernd and Sup. Chris Daly voted against motions to delay consideration of several measures — including splitting appointments to the Rent, Recreation and Park, and Municipal Transportation Authority boards; revenue measures; and requiring police foot patrols — until after approval of the city budget.

"What is the connection between [seismic retrofit] bonds and the budget?" Elsbernd asked as Budget Committee chair John Avalos made the motion to delay consideration of the $46 million general obligation bond Newsom proposed for the November ballot.

Avalos made an oblique reference to "other meetings" that were happening down the hall. Daly then criticized the maneuver, noting that "vote trading is illegal," later citing a 2006 City Attorney’s Office memo stating that supervisors may not condition their votes on unrelated items.

But that didn’t stop supervisors from engaging in a complex, private dance with the Mayor’s Office and other constituencies that day. In the end, the board approved the budget on a 10-1 vote, with Daly in dissent. Then Chiu provided the swing vote to kill the progressive proposal to split with the mayor appointments to the Recreation and Park Commission, with Sups. Daly, Avalos, Ross Mirkarimi, David Campos, and Eric Mar on the losing end of a 5-6 vote to place the measure on the fall ballot.

A measure to split appointments to the Rent Board was defeated on a 10-1 vote, with Daly dissenting, although that seems to be tactical concession by progressives. Campos, who sponsored the measure, said landlord groups were threatening an aggressive campaign against the measure that would also seek to tarnish progressive supervisorial candidates.

Removal of an MTA reform measure from the ballot, another mayoral demand, was also likely at the July 27 meeting (held after Guardian press time). Chiu told his colleagues July 20 that he was still negotiating with the mayor on implementing some of its provisions without going to the ballot this year.

Chiu rejected the notion that he cut an inappropriate budget deal, saying he was concerned the split appointment measures would be portrayed as a board power grab, noting that community groups need the funding that Newsom was threatening to withhold, and saying the board’s threats not to fund Newsom’s Project Homeless Connect facility and Kids2College Savings program were also factors in the deal.

"We were engaged with a number of conversations, they all took time, and we didn’t finish until very late," Chiu told us.

Even Daly acknowledged supervisors had few options to counter Newsom’s threats, but told us, "It’s just not the way we should be doing things."

The decision on three revenue measures (a parking tax increase, property transfer tax, and business tax reform) was set for July 27, with sources telling the Guardian that only one or perhaps two would make it onto the ballot. Newsom opposes all of them. Also hanging in the balance was Mirkarimi’s ballot measure requiring police to do more foot patrols, as well as another version in which Chiu added a provision that would invalidate the Newsom-backed ordinance banning sitting or lying on sidewalks, a retaliation for Newsom inserting a similar poison pill in his hotel tax loophole measure that would invalidate the hotel tax increase that labor put on the ballot if it gets more votes.

But most of the action was on July 20. The Transportation Authority (comprised of all 11 supervisors) voted 8-3 (with Chiu, Avalos, and Mar opposed) to place a $10 local vehicle license fee surcharge on the ballot, which would raise about $5 million a year for Muni. A Daly-proposed ballot measure to create an affordable housing fund and plan failed on 4-7 vote, with only Campos, Mar, and Chiu joining Daly.

There were some progressive victories as well. A charter amendment by Mirkarimi to allow voters to register on election day was approved 9-2, with Elsbernd and Alioto-Pier in dissent. A Chiu-proposed measure to allow non-citizens to vote in school board elections was approved 9-2, with Elsbernd and Carmen Chu voting no. And a Daly-proposed charter amendment to require the mayor to engage in public policy discussions with the board once a month was approved 6-5, opposed by Dufty, Alioto-Pier, Elsbernd, Maxwell, and Chu.

But the busy day left some progressives feeling unsettled. "How do you do this and not be trading votes?" Campos told us. "In the end, we’re saving programs, but what does it say about the institution of the board?"

Newsom spokesperson Tony Winnicker denied that the mayor made inappropriate threats, but confirmed that a deal was cut and told us, "Yes, the Mayor made his concerns about the budget clear. Yes, the mayor made his concerns about the charter amendments clear."

The bridge isn’t the only problem with Lennar’s plan

I’m glad to see the New York Times circle back to the Candlestick-Shipyard development with an article that was a tad more critical than their previous piece.

But while I enjoyed NYT’s joke about how the proposed bridge over the Yosemite Slough “has become a 950-foot-long chicken bone that keeps getting stuck in San Francisco politicians’ throats,”  I’m afraid the Board is in greater danger of choking on the bones of red herrings that they have been fed about this project,  along with last week’s bombshell that the Board won’t be able to amend Lennar’s plan, after all, when it votes July 27 on this massive proposal..

D. 10 candidate Tony Kelly says if that bombshell turns out to be true, it’ll be another example of what he calls, “The bait and switch and switch,” on the deal.

“I’m worried that the Board is getting advice that is less about a case of not being able to vote, and more a case of, if you vote, you could open up the city to liability,” Kelly said.

“Back in 2008, folks were told, just vote for Prop. G because it’s just a concept and we’ll have a robust conversation about the plan itself, but they’ve been running away from that promise ever since,” Kelly explained. “And during the EIR hearings, we were told that folks were simply approving the environmental impact report, not the plan itself.”

Kelly’s critiques of Lennar’s plan and the process by which it has been winning final approvals helped him win former Board President Matt Gonzalez’s endorsement last week in the pivotal race to replace termed-out D. 10 Sup. Sophie Maxwell.

But Kelly worries about the fallout that the next D. 10 supervisor will be left to mop up, if the Board goes ahead and approves Lennar’s plan, as is.
 
“What I’d dread to see happen is that this plan get bullied through on an up and down vote, and then a fifth, or even a tenth of people’s concerns prove to be true, and the next D. 10 supervisor spends the next 4-8 years apologizing to the people of the Bayview, because they won’t be able to do anything else for the area, and this plan keeps lumbering along and doesn’t even work,” Kelly explained.

He says he wants to know who can amend the plan, if it’s not the Board and when.

“ My concern is that after the July 27 vote, the city and Lennar will never have to come before the Board again,” Kelly said, pointing to the uncritical endorsement of the project EIR that the Planning and Redevelopment Commissions, the lead agencies on the plan, made June 3, and who would likely be tasked with any additional studies and findings.

Sup. Ross Mirkarimi confirmed today that the Board has been told that it has limited reach because of Redevelopment law, which supercedes municipal law.”
“But, nonetheless, I’m going to try to make some amendments,” Mirkarimi said.

He noted that the five amendments that Board President David Chiu introduced July 12 during a Land Use Committee hearing were “very benign.”

‘They mostly restated what was already in the project agreement or project EIR,” Mirkarimi said. “So, they don’t amend much, because they are statements of what has already been evaluated or pre-agreed to by Lennar and the city. And they are very benign because they do not require any changes to the plan.”

Mirkarimi observes that the current process by which the city is trying to push this deal through is designed to lock the Board out.

“There are larger questions in play here about our relationship with the Redevelopment Agency and redevelopment law,” Mirkarimi continued. He notes that San Francisco is one of only a few counties in California where the Board is not the same entity as the Redevelopment Agency.

“It’s long overdue that we return to the idea of having the Board have authority over the Redevelopment Agency, it’s been a problem for 40 years,” Mirkarimi said,  referring to Redevelopment’s disastrous handling of the Fillmore, which resulted in the massive and mostly permanent displacement of the Western Addition’s African American community—a negative consequence that many fear will be repeated by the plan for Candlestick-Hunters Point.

“There is a real capitalization on a starving population which is desirous of and at times desperate for positive changes and for jobs and housing, which is understandable,” Mirkarimi continued. “But absent of any alternative, it’s logical that this plan would move forward.”

In an effort to improve the plan, Mirkarimi says he will try to introduce a range of amendments at the Board’s July 27 meeting.

‘These include an attempt to make sure that whatever changes the Board makes are indeed enforceable,” he said. “And I am not satisfied with the discussion on the bridge, and how the gate has been left open on a bridge of any kind.”

Mirkarimi notes that there has been a lot of fanfare surrounding a community benefits agreement that various community-based organizations, labor and the project proponents entered into, in spring 2008.

“But I think they can do better, especially in reaching out to a community that has a high ex-offender population, and connecting to other disadvantaged communities throughout the city,” Mirkarimi said.

He also wants to ensure that if public power is not implemented, or fails, then Community Choice Aggregation program would automaticcally take over.

Mirkarimi is further concerned that there is nothing in the current plan that defines the percentages of housing units offered for rental and for home ownership.

“We are proposing to build 10,500 units but we have no idea what percentage is rental,” he said, noting that he also has concerns about air quality, air monitoring and parcels of land that have not yet been cleaned up to residential standards.

“Parcel E-2 is the most famous, but it’s not the only one,” he said. “The bridge and Parcel  E-2 have become major distractions in that they have sucked the oxygen out of other areas of these gargantuan project.”

So, is it true that elected officials on the Board can’t amend a plan sent to them by the Redevelopment Agency, whose commissioners are all political appointees of the mayor?

“It’s a yes or no vote, if you will,” a deputy City Attorney told the Guardian, on background, noting that the Board could tell Redevelopment that it doesn’t like the plan and wants the Agency to make some changes and bring it some amendments.

“Ultimately, the Board has the final say, but it has to have gone through the Redevelopment process and its PAC (project area committee) and have seen a plan that has been referred to it by the Planning Commission,” the deputy city attorney continued.“So, they could communicate their dissatisfaction and the agency would have to take their view into account. It’s not that the Board has no authority, but it can’t decide unilaterally.”

The City Attorney’s Office also confirmed that under Redevelopment Law, local jurisdictions can decide how to implement redevelopment plans.

“In a number of jurisdictions, the city council has made itself a Redevelopment entity, just as our Board is also the Transportation Authority in San Francisco,” the deputy said.“And if the same body proposes the plan, it probably will be satisfied.”

The City Attorney’s office noted that if agencies that regulate permits to fill the Bay, as is  required to build a bridge over Yosemite Slough, deny the city those permits, then the city would require amendments to its planning documents, but no further environmental impact review would be required, if the bridge was gone.

With the Board’s July 27 vote around the corner, D. 10 candidate Tony Kelly says he has a bunch of concerns that include, but are not limited to the bridge, starting with the projects financing mechanisms.

Kelly points to the fact that city staff recommended and the Board approved July 13 that “significant blight in the project area cannot be eliminated without the increase in the amount of bonded indebtedness from $221 million to $900 million and the increase in the limitation on the number of dollars to be allocated to the Agency from $881 million to $4.2 billion.”
 

Kelly wants the city to explain to the Board how much tax increment financing money will be left for the Bayview, now that the area’s debt ceiling has been tripled.

“Does this mean that all BVHP property tax revenues for the next 30 years will go towards paying down this debt and nothing else?” Kelly asked. “And what will that mean for the rest of BVHP in terms of service and programs it won’t be able to afford?

Kelly would also like to see the Board request an audit of Lennar’s record on Parcel A. As Kelly points out, the Navy conveyed Parcel to the city in 2004, and the city gave Lennar the green light to develop 1,600 mostly luxury condos on that parcel, in 2006.

“But no one has ever done an audit of Parcel A,” Kelly said. “Given the scrutiny that the Board usually brings to five figure numbers, the supervisors should be demanding this information, since we are dealing with a ten-figure number ($4,220,000,000) in future.”

It would be helpful if the City would also brief the Board as to who it believes will be investing in the project,  including the investment companies’ names,  their board of directors, and whether these companies are based in the US. Rumors are swirling that some project proponents have entered into side-deals that involve limited liability companies that are selling Lennar’s proposed condos to folks in China, and that a $1 million investment in a condo could translate into a work permit for the condo owner or occupant.

Kelly worries that the city and Lennar’s joint redevelopment plan is being allowed to squeak past the Board’s financial review simply on the basis of vague estimates.
“They rely once again on promises that won’t show up,” Kelly said, pointing to a recent report that emerged from the Controller’s Office.

Arc Ecology’s Saul Bloom notes that the Controller used averaged figures in that report, an approach that neatly obscures the fact that many of the project’s alleged and benefits– will not be created or felt for years. Bloom for his part is hoping the Board can introduce a maritime uses amendment. This would allow relatively unskilled jobs to be created at the shipyard in short order, compared to vague promises of  building a green tech office park there, some day.

Last week, Mayor Gavin Newsom’s top economic advisor Michael Cohen suggested that plan amendments would delay project construction.

But Cohen was quick to add that, “702 acres of waterfront land in San Francisco is an irreplaceable asset. It’s not a question of if—but when—it gets developed.”

Others are less sure that Cohen’s much promoted vision will ever translate into reality.

So, here’s hoping the Board will grill Cohen and city staff over the financial details, including the internal rate of return (IRR) that Lennar is demanding, and what will happen to promised community benefits, if the IRR doesn’t pencil out. D. 10 candidates DeWitt Lacy, Chris Jackson and Tony Kelly have suggested that some form of liquidated damages  are needed, but if the City believes these are unnecessary, it should explain why.

And then there are questions about the impact on air quality of the traffic related to an additional 24,500 residents and 10,000 workers into the city’s southeast.

Personally, I was fascinated by an April 2010 report from the Redevelopment Agency in which the agency discussed the challenges of driving piles through contaminated soil, which is what could happen if a bridge is built over the Yosemite Slough. In the past, the city made the argument that the NFL and the 49ers were requiring this bridge.

But last week, in the wake of Santa Clara’s vote in favor of a new stadium for the 49ers near Great America, the city began arguing that the bridge would make the project more attractive to financers, because employers want to get their employees quickly in and out.

This was the first time I ever heard city staff make that particular argument and they made it when it’s still not clear who these employers even are.

 So, let’s flesh out the list of potential employers, so the Board can determine if design decisions are being made in the interest of the local community or out-of-state businesses.

And then there’s the fact that it appears that this proposed $100 million bridge would only save commuters a few minutes, while permanently filling the San Francisco Bay.

Today, the Sierra Club, the Golden Gate Audobon Society, the California Native Plant Society and San Francisco Tomorrow released a report that asserts that the Candlestick Point-Hunters Point Shipyard EIR “misrepresents the need for a bridge.”

“A statistical review demonstrates that a route around Yosemite Slough could be as efficient as a bridge route while being better for the environment,” stated a letter that the Sierra Club-led environmental coalition released today. “It’s time for the Board of Supervisors to reject the bridge alternative and insist that the feasible upland route around Yosemite Slough be seriously considered.”

The letter argues that a regression model result found in the Transportation Study Appendix F of the Candlestick Point-Hunters Point Phase 11 EIR provides “no statistically significant evidence to support the claim that a 5 minute increase in transit travel time would lead to a 15 percent decrease in transit ridership, or, indeed, to any decrease in ridership.”

“Therefore, routing the BRT around Yosemite Slough is as consistent with a transit-first redevelopment goal as a bridge alternative, but without the environmental damage wrought by the bridge,” the Sierra Club-led report states in summary. “The results of the regression analysis used in the EIR and relied upon to support the bridge alternative have been misinterpreted in such a way that even if they were statistically significant they are off by a factor of ten: the decrease in transit ridership associated with 5 extra minutes of transit time would be predicted to be approximately 1.5 percent, not 15 percent,” it concludes.

“When the analysis [presented in the Sierra Club’s letter] is combined with previous analyses by LSA Associates (which estimate the increase in travel time would be approximately 2 minutes, rather than the 5 minutes in the final EIR) and other available information, one must reach the conclusion that the FEIR misrepresents the effect on travel time and ridership that would result from a route around Yosemite Slough. Overall, it poses further questions about the need for a bridge over San Francisco’s largest wetland restoration project.”

The Sierra Club-led report lands two weeks after Board President David Chiu introduced his July 12 package of amendments which seeks to narrow the bridge, not eliminate it, and require the Board to hold hearings before the Navy transfers Parcel E-2 to the city.

It’s a good idea for the Board to require hearings before E-2 is transferred to the city. But does this mean the Board will be able to direct the Navy, when it’s time to decide whether to cap or excavate the contamination in that parcel? The answer appears to be no. All the Board can do is to reject the Navy’s proposed solution.

But how would this work? What would happen then? And Parcel E-2 isn’t the only parcel on the shipyard where seriously nasty stuff has been found and is still be cleaned up.

The good news is that at this point, the project still doesn’t belong to the Board.

The bad news is that, as of tomorrow, it could belong to them, if the supervisors opt to approve Lennar’s plan with a simple up-down vote. And given the rush and the political pressure that the process has been subjected to since 2006, it’s almost certain that some scandal will engulf the project, some time in the future. And this Board of Supervisors’ names will be on it. Even if nothing ever gets built at the shipyard.

“How can the city say nothing will be built for years, because we have promised so much, when they say out of the other side of their mouth, that the only way that we can make these promises to the community, is if the community supports the plan?” Kelly asks. “On what planet do we think this makes sense? I think we are moving out of the solar system with every passing week.”

There’s no crime in members of the Board admitting tomorrow that they have not read the entire plan and don’t understand all the details. As the folks in Alameda humbly admitted last week, when they kicked out developer SunCal, it took them years to understand what was being proposed—including the fact that the project might leave their city in the hole, financially.

But it would be a crime for the San Francisco Board of Supervisors to vote yes on this massive proposal without first having done that homework. Yes, I’ve heard supervisors say in the past they are deferring to Sup. Maxwell, since the project lies in her district. But Maxwell is termed out, and the project will impact all of the city, especially in terms of its ethnic and economic diversity, in future. So, as we’ve said, buyer beware!

 

Rumors fly that Board can’t amend Lennar deal, after all

For the past month, fireworks and deals have been going on at City Hall as the Board prepares to vote on Lennar’s massive redevelopment plan for Candlestick Point-Hunters Point Shipyard. And recently, the Board vowed to make a slew of amendments to the plan, even as they approved the project’s environmental impact report.

But now it’s beginning to look like the only winners could be the developer—and perhaps those folks at city hall who are staking their political careers on jamming this deal over the finish line, come hell or high water, before the November election comes around and they go into the private sector as real estate developers.

I say this because two weeks ago, the progressives on the Board were saying that they had been told that they couldn’t amend the EIR July 14, but that they could amend the actual redevelopment plan when it comes before them on July 27. It was for this reason, they said, that they decided to vote to accept the EIR in an 8-3 vote, with only Sups. John Avalos, Chris Daly and Eric Mar, voting to reject the project’s key environmental document.

But today, with less than two working days before the Board’s July 27 meeting, I’m hearing rumors that the Board will only be able to take an up and down vote, when they consider Lennar’s actual redevelopment plan.

In other words, the only way the Board would be able to change anything would be to reject the plan in its entirety.But everyone knows that this is a pigs-may-fly scenario, given the massive pressure the Mayor’s Office, labor and Lennar have been exerting on the Board.

So, if these “up-and-down-vote only” rumors turn out to be true, folks who care about environmental and economic justice better start sounding the alarm. Because there is a plethora of unresolved issues that Sups. John Avalos, David Campos, Chris Daly, Eric Mar, and Ross Mirkarimi identified July 13 as needing shoring up, before the actual redevelopment plan would ever pass their sniff test.

These concerns included fears that the project’s financing plan amounts to daylight bank robbery, that the proposed bridge across the Yosemite Slough is unnecessary, and that the amount of projected air pollution related to the development is unacceptable.

And then there’s the fact that the Controller’s “economic benefits” report only used averaged figures, and therefore did not give any details about how many jobs and benefits the project would create in this economically depressed community in the next few years.

And did I mention the part about liquidated damages and watershed concerns? Or the fact that there are no maritime uses in the current plan, even though these uses could translate directly into relatively unskilled jobs, if old ships were broken up at the shipyard.

But despite the hours of discussion on July 13 that the Board sat through last week, I do not recall anyone from the Mayor’s or City Attorney’s Office advising the supervisors that they would not be able to amend the actual plan when it comes before them July 27.

Right now, a lot of confusion is swirling as folks point to the fact that Board President David Chiu introduced five amendments at a July 12 Land Use Committee hearing that eight supervisors subsequently voted to accept. This move led the rest of the Board to believe that they too could make amendments to the final plan.

But a review of Chiu’s amendments and the project’s EIR suggests that these changes are in fact repackaged pieces of the EIR, and that the move misled other supervisors into believing that that they would have a chance to amend the actual redevelopment plan.

So far, no one from the Mayor’s Office has returned my calls seeking clarification on this process. But if it turns out that the only way the Board can have input is to kick the plan to the curb, or ask the Planning Commission to make new findings, then democracy in San Francisco has been replaced with an empty charade.

“The Board can make changes along the line that David made in the Land Use Committee, “ Chiu’s legislative aide Judson True told me today. But he wasn’t clear on the process next week, and suggested that I call Cohen’s office, which I did (only to find myself shunted to Cohen’s voice mail.)

So, what gives? And why would the Board allow an out-of-town developer in partnership with the Mayor’s Office to sidestep its responsibility in this way?

“We were told we could not make amendments to the EIR, but could make amendments to the plan that we will be voting on this Tuesday,” Campos told me today, noting that he and Mirkarimi were prepared to make changes July 13, but were then told they could not do that.

“The biggest fear I have with this project, and any project this size in this economy, is that a lot is promised, but will anything get developed, or will we be stuck holding the bag,” Campos added.

Similar questions led the Alameda city council to kick developer SunCal to the curb last week. Ironically, the move could open the door to a developer like Lennar to try and swoop in and pick up the pieces in the island city across the Bay from San Francisco.

But folks in Alameda are pointing to San Francisco as an example of how difficult it is to nail down developers, noting that Michael Cohen, Mayor Gavin Newsom’s top financial advisor, recently admitted that investment money is scarce, even though the city’s EIR for the project has been approved.

Actually, Cohen went a step further by intimating that all the benefits that the community wants out of the plan would deter investors even more—comments that were perhaps just a precursor to this potential bombshell that the Board won’t actually be able to amend the deal, after all? Stay tuned.

Arrests made as hotel workers and their supporters target Hyatt

An ongoing labor conflict between the hospitality workers union Unite-Here Local 2 and the Hyatt Corporation boiled over into the streets yesterday (7/22) with a union-organized protest and civil disobedience outside the Grand Hyatt San Francisco hotel. Union leaders see the action as another step in the fight for their members’ workplace rights. Hotel management called the action a staged spectacle and a waste of energy that would be better spent at the bargaining table.
San Francisco hospitality workers have been without a contract for nearly a year as Local 2 and hotel management of several corporations have reached an impasse over securing health care benefits, pension improvement, wage increases, and the right to organize without intimidation from employers. San Francisco Police Department Sgt. Tadao Yamaguchi confirmed that 150 demonstrators were arrested after blocking Stockton Street outside the Grand Hyatt San Francisco hotel. All were cited and released.

“The Hyatt Corporation has repeatedly said they want workers to pay hundreds of dollars per month for family medical,” Local 2 spokeswoman Riddhi Mehta told the Guardian. “Workers have sacrificed wages for decades to keep health care, to the point that their average income is $30,000 to $35,000 per year.”

Hyatt spokesman Peter Hillman told the Guardian that management wants to renegotiate the health care portion of the contract, but that negotiations hadn’t reached the point to make specific demands for worker contributions to the plan.

“They are sitting on top of $35 million that could be used to help address the overall health care plan that hasn’t been addressed in 30 years,” Hillman told us. “If there is finger pointing on profits and all that, I would ask them why they haven’t opened up that?”

Mehta told the Guardian that $35 million is in an health and welfare trust fund specifically for emergencies, like earthquakes or lockouts in which union members aren’t working enough hours to get health benefits. Local 2 President Mike Casey told the Guardian that the union does not control the trust fund. It’s managed by trustees from both employers and the union. “Bringing this up is it’s a delay tactic on their part,” Mehta said.

Casey, who was arrested during the demonstration, said it was a success. “We’re going to win,” he said. “It’s going to take some time. It’s a question of who’s going to last one day longer than the other side.”

“The game Unite Here is playing is to generate more union membership, to some extent at the expense of the current membership,” Hillman said. “These are staged spectacles. The energy would be better spent at the bargaining table and we encourage Local 2 to come back to that.”

Unions say grand juror unethically helped Adachi measure

San Francisco’s police and fire unions are taking a lead role in opposing Public Defender Jeff Adachi’s November initiative to make city employees pay more of their pension and health care costs, despite the fact that both unions have recently renegotiated their contracts to exempt their members from paying those increased costs until 2013.

The unions and Bob Muscat from the San Francisco Labor Council recently formed the group Stand Up for Working Families to run the opposition campaign to Adachi’s SF Smart Reform, yesterday holding a press conference at City Hall to highlight the allegedly unethical role that a grand juror has played in pushing the Adachi measure.

Civil Grand Jury member Craig Weber led the committee that in June released a report on the city’s pension system called “Pension Tsunami: The Billion Dollar Bubble,” warning that employee pension costs to the city would more than double in the next five years and “fundamental adjustments must be made to the City’s employee pension program.”

Yet by the time that report came out (following a similar grand jury report from a year earlier), Weber was already working as treasurer for the Adachi’s signature-gathering campaign, which City Attorney Dennis Herrera called an inappropriate conflict of interest and which Muscat says that raises questions about data manipulation and access to secret grand jury proceedings.

“I have serious concerns in this particular instance that Mr. Weber’s dual roles create a conflict of interest, or at least the appearance of conflict of interest, which would undermine the integrity of any Civil Grand Jury investigation into these issues,” Herrera wrote in a June 14 letter to Presiding Judge James McBride, relating how Weber had sought advice from Herrera’s office on the matter in March and that both Weber and the Grand Jury chair refused to heed his advice that Weber recuse himself from working on the report.

“We believe he used his position on the Civil Grand Jury to manipulate the civil grand jury report,” attorney Peter Saltzman, who represents opponents of the measure, said at the press conference.

But Adachi called the charges “just smoke and mirrors,” telling the Guardian that his initiative was based on data from the Controller’s Office and that the measure was written and publicly available before the latest grand jury report was released. “We received zero information from the grand jury,” Adachi told us. “We relied on public information that we received from the Controller’s Office.”

He has claimed the measure will save the city about $167 million per year by making city employees pay more into their pensions and health care costs for their dependents, although that figure will be lower for the next two years because of exemptions that were written into five police and fire memorandums of understanding that the Board of Supervisors approved last week, agreements negotiated by the Mayor’s Office and opposed by Sups. David Campos and Chris Daly (Sup. Ross Mirkarimi also voted against the MOU for Fire Department executives) because of the exemption.

Police union head Gary Delagnes, who was at the press conference, told the Guardian that the special consideration for those two unions – both of which are key supporters of Mayor Gavin Newsom — was simply a function of negotiating their MOUs later than the other unions. “By the time we and the firefighters were in there, this thing [Adachi’s campaign] had really picked up steam,” he told us.

During the press conference, Muscat highlighted how billionaire Michael Moritz, managing partner of Sequoia Capital, put almost a quarter-million-dollars into qualifying the Adachi measure for the ballot and said, “This is a measure not in the interests of anyone in San Francisco and it represents the interests of people outside of San Francisco” who are attacking public employee unions for political reasons.

Safety first!

The number of serious on-the-job accidents this year have yet again made very clear the urgent need for expanded and tightened government safety regulation. The toll on workers has been high, as President Cecil Roberts of the United Mine Workers union told the House Education and Labor Committee in mid-July.

Roberts noted the explosion at a mine in West Virginia that killed 29 coal miners, a blast at a refinery in Washington State that killed seven workers, the BP oil rig blast in the Gulf of Mexico that killed 11, an explosion that killed six workers at an Energy Systems facility in Connecticut.

Those were but a very small sampling of the on-the-job accidents that kill nearly 6,000 U.S. workers every year. More than two million other American workers are seriously injured yearly. And another 50,000 or more die yearly from cancer, lung and heart ailments and other occupational diseases caused by exposure to toxic substances.

The Mine Workers’ Roberts came before the House committee to urge passage of a bill, the Miner Safety and Health Act, that focuses on mine safety but also includes provisions that would strengthen safety protections in all other workplaces.

Joe Main, who heads the federal Mine Safety and Health Agency, said the bill would do nothing less than “change the culture of safety in the mining industry, and put the health and safety of miners first.”  That indeed would be a major shift in focus, a very much needed and most welcome shift.

It’s sad but true that the safety of miners has often been a secondary consideration of many mine owners and government regulators. Greater profit and productivity – not safety – has been the overriding concern, and far too many workers have suffered because of that.

Too many have been maimed, too many killed for lack of proper protections, some required by law but ignored, some not required at all, however essential they are.

The Mine Safety and Health Agency’s Main says the proposed law would give his agency the tools to make employers live up to their legal and moral obligation. And if they don’t meet their obligation, the agency would be empowered to step in to see that they do so.

As the AFL-CIO’s general counsel, Lynn Rinehart, told the House committee, the federal job safety laws – now 40 years old – are way out-of-date. They have never been significantly strengthened, Rinehart noted, and their penalties are slight compared to those imposed for violations of other labor laws.

What’s more, Rinehart said, the law gives workers little protection from employer retaliation against those who raise safety concerns. Current law, he added, “simply does not provide a sufficient deterrent against employers who would cut corners on safety and put workers in harm’s way.”

Among the bill’s most important provisions is one that would guarantee workers the right to refuse to work in unsafe conditions. That right is guaranteed in mineworker union contracts, and for good reason: Non-union miners have long complained that they fear employer retaliation if they speak out about mine safety problems.

The bill would give the mine safety agency authority to close a mine if there’s a continuing threat to workers safety, and would subject mine owners to increased civil and criminal penalties for safety violations.

The AFL-CIO’s Rinehart noted that the median penalty for having working conditions that cause a fatality was a mere $5,000 in 2009. The penalties generally have been mere slaps on the wrist.

One of the most important parts of the proposed safety law would extend coverage of the Occupational Safety and Health Act  – OSHA – to the millions of local and state government employees who are not covered by the law.

Sponsors of the proposed law face formidable opposition – the National Association of Manufacturers, U.S. Chamber of Commerce and nearly two dozen other industry groups whose members aren’t eager to spend money on safer workplaces.

The Bush administration was openly on the side of those groups. Safety laws were only lightly enforced – if enforced at all – by the Bush appointees who ran the federal safety agencies. Peg Seminario, the AFL-CIO’s safety and health director, figures it will take years to reverse and undo the “many bad policies and practices that were put into place” under Bush.

It will indeed be a long time before the government can provide the full protection from on-the-job hazards that will continue to needlessly harm millions of American workers. But the proposed new safety law, and the worker-friendly Obama administration, give us a fighting chance to finally do what must be done if we are to have truly safe workplaces.

San Francisco Jewish Film Festival: “Protektor” and “A Small Act”

Protektor (Marek Najbrt, Czech Republic, 2009) Marek Najbrt’s pomo period piece — spiced by switches from color to monochrome, soundtracked DJ mashups, and other bendy tropes — provides an elegant yet energetic reprise of some familiar themes. Rising Czech film actress Hana (Jana Plodkova) refuses to leave Prague despite the considerable danger posed by her (secret) Jewish identity. Husband Emil (Marek Daniel) is a popular radio host who struggles to protect her as he nonetheless rises in favor under the wartime Nazi “protectorate.” But Hana proves uncontrollable as wife and (eventually boycotted) thespian, unable to keep her libido or boredom safely wrapped. And Emil’s bosses soon enforce a cruel choice. Protektor is self-conscious, but also surprising — the highly stylized presentation lends what could have played as an ordinary, earnest victim scenario an edge more seductive than distracting. A Small Act (Jennifer Arnold, United States, 2009) Ain’t gonna lie — I settled in to watch A Small Act thinking I’d be bored by a well-intentioned but manipulatively “uplifting” story. Boy, was I wrong. This is a complex, layered tale that features all the elements a compelling documentary requires, starting with its fascinating subjects. Born into poverty, Kenyan youth Chris Mburu was able to pursue his education thanks to Hilde Back, a Swedish woman who donated a few dollars a month to sponsor his education. Though they’d never met, he could not forgot the stranger who’d enabled him to finish high school (he ended up going to college, then Harvard Law School, and now has a prestigious job at the United Nations). Years later, Mburu named a foundation after Beck to give scholarships — and hope for a future beyond teenage pregnancy and a life of back-breaking labor — to Kenyan kids from his home village. Now, the joyful moment where Mburu and Beck meet for the first time comes pretty early in the film, which is when I realized that filmmaker Jennifer Arnold was going to dig way deeper with her doc than I originally suspected. First, there’s a whole plot thread about three bright kids who are frantically studying to take Kenya’s national exam (high marks would qualify them for one of Mburu’s scholarships), plus one about Beck’s life in Sweden (and her past as a Holocaust survivor), plus yet another about post-election unrest in Kenya that threatens not just the children we’ve met in the movie, but Mburu’s own family. Newsom’s extortion

The mayor really wanted the supervisors to get rid of two reform measures that would have shifted to the board some of the appointments to the Recreation and Park Commission and Municipal Transportation Agency. The landlords really wanted the board to scrap a plan to reform the Rent Board. And both got exactly what they wanted.


I agree that the budget has some good news, that Newsom has agreed to fund more than $40 million worth of necessary services that he initially wanted to cut. But the price was high: The supervisors had to go along with Newsom’s attempt to undermine structural reforms at two city agencies. The mayor essentially held the board hostage: If he didn’t get his way on issues totally unrelated to the budget, then he’d refuse to pay for a long list of things that the supes wanted. (And these weren’t pet projects of board members; we’re talking about life-saving essential services. The mayor in effect said that he’d allow desperately sick people to die on the streets for lack of a bed at SF General if the board tried to take away his ability to pack Rec-Park and MTA with his favorite political hacks. Sweet guy, huh?)


Is balanced representation on two important city agencies worth the price of $43 million in cuts to essential programs? That’s a nasty question, and the mayor put the board in a very bad position. In the end, the supes could have stood up to his extortion, and didn’t.


Meanwhile, the landlords threatened to spend millions to defeat a measure reforming the Rent Board — and then they threatened to also pour money in to supporting Public Defender Jeff Adachi’s pension measure, which labor is really nervous about. And there was always the implied threat that landlord money would go into the district supervisor races. So progressives decided that they couldn’t win that battle and the rent board measure died


And, of course, Newsom’s sit-lie law and his plan to kick members of the Board of Supervisors (but not himself) off the Democratic County Central Committee are both still on the ballot. He didn’t give up a thing.


So the landlords and the mayor won this round, but the supes can still fight back. What Newsom did was unconscionable; it’s not as if he was negotiating a tax hike measure against cuts, or a measure that would have mandated new spending against reductions somewhere else. He took two items that had nothing to do with finance and made them bargaining chips in the budget discussions.  If the supervisors did that, they’d be violating state law, which forbids vote trading.


So what San Francisco needs now is a law that bars the chief executive from vote-trading, too. Let’s get that introduced and approved — and see if Newsom wants to veto it.

Known for his stage antics, the Nobunny leader — and sole member, really, if you exclude the backing musicians shuffling in and out — is something of a rock ‘n’ roll animal classified in the punk rock phylum (or garage rock class). Love Visions (2008), with homages like “Chuck Berry Holiday,” produced catchy tracks faster than a rabbit could procreate. Five Easy Pieces

A few years after creating wannabe-pop group the Monkees, Bob Rafelson wrote — along with Carole Eastman — and directed 1970’s Five Easy Pieces. Like Easy Rider (1969), it’s a man-is-a-lonely-island-unto-himself picture starring Jack Nicholson and the squalid splendor of the American landscape. Bobby leaves his affluent family for the life of an oil rigger, but what he finds are consequences both understated and overwhelming. Nominated for four Oscars, Pieces is not an easy film. Like the literature of Cormac McCarthy or Hemingway, it’s biblical, masculine stuff. Yet for all its ruggedness, it has a bittersweet side worth noting for Laszlo Kovacs’ muted cinematography, as well as the weepy country tunes of Tammy Wynette. (Lattanzio)

“Wondrous Strange: A Twenty-First Century Cabinet of Curiosities”

The medieval notion of a cabinet of curiosities or Wunderkammern holds great fascination to this day, even though a room filled with animal bones, coins, and unmarked pottery shards would seem a fairly undisciplined display format for scientific artifacts at this point. But if the Wunderkammern is academically anachronistic, the folks at SFMOMA Artists Gallery still find it a useful vehicle for conveying art and culture. The opening of “Wondrous Strange” will feature a time traveler costume contest, burlesque performance by the Burley Sisters, and music from the Grannies. The opening ceremonies will also extend to the nearby Long Now Foundation (also in Fort Mason’s Building A), where interested parties can check out their prototypes for the 10,000 Year Clock. Behind the Burly Q

While relatively tame by today’s standards, burlesque was once perceived as a scandalous art form. Featuring comedians, strippers, and satire, burlesque threatened conservative views about sex and sought to undermine accepted social norms. Even though vaudeville-inspired acts have recently made a nostalgic comeback, their roots remain widely misunderstood. Director Leslie Zemeckis’ documentary Behind the Burly Q goes straight to the source to uncover more than just pasties. By interviewing many of the women and men who starred and worked in the industry, Zemeckis traces the often overlooked history of American burlesque and honors all those who managed to use a g-string as a political weapon. Along with most of the rest of his band, Cynic guitarist Paul Masvidal avoided an awkward ’90s-metal swan song by disappearing into the jazz scene. Suddenly, in 2006, Masvidal and his main collaborator, drummer Sean Reinert, resurfaced with a renewed sense of purpose, and the release of 2008’s Traced in Air ushered in an era of relentless touring that saw the prog-metallers quickly reestablish their towering reputation. Carmina Burana: Revisited

For a few years, choreographer Enrico Labayen disappeared from the local radar screen. He now has reemerged with an ambitious full-evening work based on two rituals from opposing sides of the planet. Turns out that Labayen, an early member of Alonzo King’s LINES Dance Company who also has 15 years’ experience as an independent choreographer, spent the intervening years in his native Philippines to study the matriarchal aspects of its culture that have long fascinated him. His new Carmina Burana: Revisited delves into Carl Orff’s raucous reimagining of Medieval European Christianity for a work that explores the choreographer’s own memory of Tadtarin, a Philippine ritual that celebrates femininity. Previously, L@TE has brought in such luminaries as Terry Reilly and the Residents; later this summer the series features sometime Grouper collaborator Jamie Stewart of Xiu Xiu. Bay Area Rockin’ Solidarity Labor Chorus

If you have any affinity at all for the American labor movement, these are depressing times. All that populist energy generated in the wake of 2008’s financial meltdown seems to have been wasted on fruitless antigovernment paranoia, while essential state services are being eliminated nationwide, taking thousands of union jobs with them. Those sympathetic to the cause of social justice can be forgiven for not feeling much like singing. On the other hand, nothing rabble-rouses like a good anthem, and no movement ever got far on despair. The Bay Area Rockin’ Solidarity Labor Chorus realizes this, and is presenting, as part of the Bay’s yearly LaborFest, a program of union songs old and new, celebrating victories won and anticipating those still to come. Queensryche and burlesque. On the one hand, it’s a completely arbitrary juxtaposition, akin to, say, “submarines and kumquats.” On the other, it makes perfect sense. The veteran Seattle prog-metal act have always had a flair for the theatrical, the lushly orchestrated, the ever-so-slightly over the top. And during a break in the recording of its new album, the band decided to really go for broke, setting out on the road with the “world’s only adults-only rock show,” featuring contortionists, trapeze artists, jugglers, and other delights. The album cover for Obits’ I Blame You claims it is “Xtra Compressed for Maximum Listener Fatigue,” and, while 41 minutes doesn’t seem like such a short album these days, the music itself has a tight, claustrophobic intensity that really good garage rock delivers so well. Lead guitarist Rick Froberg, formerly of Hot Snakes and Drive Like Jehu, journeys through all manner of rock in those 41 minutes, skewing the familiar sounds of surfer twang and post-punk into a nonstop groove that leaves the listener just as breathless as the cover promises. Obits knows you don’t have to break any musical barriers to crack a few eardrums. (Peter Galvin)

“Visions of the Gameocalypse”

In a world where gaming is “no longer just for kids!” or nerds, and where major members of the artistic establishment (cough-Ebert-cough) take up arms against the perceived aesthetic immaturity of videogames for no good reason, it would do us all a little good to get a firmer grasp on how computerized gaming has developed. Jesse Schell, CEO of Schell Games and author of The Art of Game Design: a book of lenses, will be presenting his thoughts on the “social, cognitive, and technological trends” in gaming. We can only hope the event’s gloomy title, “Visions of the Gamepocalypse,” is tongue-in-cheek, though it definitely implies a refreshingly futurist approach to games. (Stander)

Lennar Corp.’s massive redevelopment plan for Candlestick Point-Hunters Point cleared a critical hurdle July 14 when the Board of Supervisors voted 8-3 to affirm the Planning Commission’s certification of the project’s final environmental impact report, with Sups. John Avalos, Chris Daly, and Eric Mar opposed

Board President David Chiu called the vote "a milestone." Termed-out Sup. Sophie Maxwell, whose District 10 includes Candlestick Point and the former Hunters Point Naval Shipyard, saw the vote as evidence that city leaders support the ambitious plan. Yet many political observers saw the vote as proof that Lennar and its Labor Council allies have succeeded in lobbying supervisors not to support opponents of the project.

"I’m concentrating on pushing this over the finish line," Maxwell said at the hearing in the wake of the vote, which came in the wee hours of July 14 after a 10-hour hearing. Supervisors can still amend Lennar’s development plan during a July 27 hearing and project opponents are hoping for significant changes.

Mar said he wants to focus on guaranteeing that the city has the authority to hold Lennar responsible for its promises. "I want to make sure that we have the strongest enforcement we can," he said.

Lennar’s plan continues to face stiff opposition from the Sierra Club, the Golden Gate Audubon Society, the California Native Plant Society, San Francisco Tomorrow, POWER (People Organized To Win Employment Rights) and CARE (Californians for Renewable Energy).

Representatives for these groups, whose appeals of the EIR certification were denied by the board, say they are now weighing their options. Those include taking legal action within 30 days of the board’s second reading of and final action on the developer’s final redevelopment plan, which will be Aug. 3 at the earliest.

Supervisors are expected to introduce a slew of amendments July 27, when they consider the details of the proposal and its impacts on the economically depressed and environmentally polluted.

Michael Cohen, Mayor Gavin Newsom’s top economic advisor, admitted July 19 that all these various demands will likely delay project construction. "But 702 acres of waterfront land in San Francisco is an irreplaceable asset," Cohen reportedly told the San Francisco Chronicle. "It’s not a question of if — but when — it gets developed."

Chiu already has introduced five amendments to the plan in an effort to alleviate concerns about shipyard toxins, Lennar’s limited financial liability, a proposed bridge over Yosemite Slough, and the possibility that local residents will need more access to healthcare and training if they are to truly benefit from the development plan.

Sup. Ross Mirkarimi told the Guardian that he expects the board will require liquidated damages to ensure the city has some redress if the developer fails to deliver on a historic community benefits agreement that labor groups signed when Lennar was trying to shore up community support for Proposition G, the conceptual project plan voters approved in June 2008.

Mirkarimi said the board would also seek to increase workforce development benefits. "Thirty percent of the target workforce population are ex offenders. So while they might get training, currently they won’t get jobs other than construction," Mirkarimi observed.

He supports the health care access amendment and the public power amendment Chiu introduced July 21, pointing to Mirkarimi’s previous ordinance laying the groundwork for public power in the area. "This ordinance established that where feasible, the City shall be the electricity provider for new City developments, including military bases and development projects," Mirkarimi said. "PG&E was ripped when we pushed that through."

But Sierra Club activist Arthur Feinstein isn’t sure if additional amendments will help, given intense lobbying by city officials and a developer intent on winning project approvals this summer before a new board and mayor are elected this fall.

"Chiu’s amendments gave us what we asked for over Parcel E-2" Feinstein said, referring to a severely contaminated section of the shipyard for which Chiu wants an amendment calling for a board hearing on whether it’s clean enough to be accepted by the city and developed on.

But Feinstein is less than happy with Chiu’s Yosemite Slough amendment, which would limit a proposed bridge over it to a width of 41 feet and only allow bike, pedestrian, and transit use unless the 49ers elect to build a new stadium on the shipyard. In that case, the project would include a wider bridge to accommodate game-day traffic.

"The average lane size is 14 feet, so that’s a three-lane bridge. So it’s still pretty big. And it would end up filling almost an acre of the bay," Feinstein said.

Feinstein thanked Mirkarimi and Campos for asking questions that showed that the argument for the bridge has not been made. "But it’s disappointing that a progressive Board would be willing to fill the Bay for no reason," Feinstein said.

He concurred with the testimony of Louisiana-based environmental scientist Wilma Subra and environmental and human rights activist Monique Harden, who challenged the wisdom of the Navy digging out toxins while the developer installs infrastructure at the same site.

Subra said contamination is often found at Superfund sites after they have been declared clean when contractors to later dig into capped sites and expose workers and the community to contamination. Harden said the plan to begin construction on some shipyard parcels while the Navy removes radiological-contamination from shipyard sewers is "like a person jumping up and down on a bed that another person is trying to make."

But Cohen, who has aggressively pushed the project on Newsom’s behalf, countered that there is no scientific evidence to support such concerns. "It’s a very common situation," Cohen said. "It’s the basis for shipyard artists and the police being on the site for many years … It’s safe based on an extraordinary amount of data."

But Feinstein pointed to his experience working for the Golden Gate Audubon Society at the former Alameda Naval Station. He recalls how a remediation study was completed, but then an oil spill occurred at the site, which had been designated as a wildlife refuge.

"The military didn’t know about everything that happened and was stored on site, and it’s easy to miss a hot spot," he said. "And who’ll be monitoring when all these homes are built with deeds that restrict the renters and owners from digging in their backyards?"

Feinstein said he’s concerned that only Campos seemed to be asking questions and making specific requests for information around the proposed project’s financing

"Lennar is paying city staff and consultants and promising labor huge numbers of jobs. When you are throwing that much money around, it’s hard for people to resist — and the city has been co-opted," Feinstein said. "And how much analysis and resistance can you expect from city commissions when the Mayor’s Office is the driving force behind the project? So we don’t have a stringent review. The weakness of the strategy of ignoring our bridge concerns is that when we sue, we may raise a whole bunch of issues."

Arc Ecology director Saul Bloom says Chiu’s bridge proposal "screwed up the dialogue. We were close to a deal," Bloom claims. "But while that amendment allowed one board member to showboat, it prevented the problem from being solved."

Bloom is concerned that under the financing deal, the project won’t make any money for at least 15 years and will be vulnerable to penalties and bumps in the market — an equation that could lead the developer to build only market rate housing at the site.

"It’s a problematic analysis at best," he said.

"The bigger the development, the more it benefits people who have the capacity to address it — and that’s not the community," Bloom said. "So there’ll be more discussion of the bridge, and that’s where the horse-trading is going to be."

He also said the bridge has now taken on a symbolic value. "The thing about the bridge is that it’s not actually about the bridge any more," Bloom added. "It’s about Lennar telling people, ‘You will support us.’ If they get the bridge, it will give them free rein, an unencumbered capacity to do as they see fit. They are willing to make deals, but they have to have the bridge because it defeats the people who have been the most credible and visible — and then they have no opposition."

I just got back from a short trip to Canada, the land of government health care and tight bank regulations, where business is booming. From my hotel room in downtown Toronto, I could see construction cranes everywhere. The Globe and Mail had a fascinating report on a construction company manager in Winnipeg who was learning the language of the Cree tribe and creating a new apprenticeship program for First Nations people — in large part because he was facing a serious labor shortage.

Yeah, that’s right: in Canada, they can’t find enough construction workers to fill all the jobs. And there’s a good reason (which has nothing to do with zoning or taxes or fees on developers): The banks in our neighboring country to the north have always been more tightly regulated, so they didn’t have the same meltdown we saw here in the USA.

Then I came back and read that Meg Whitman, candidate for governor of California, wants to eliminate the capital gains tax in the state. I like the Huffington Post headline: "Meg Whitman tax plan: she stops paying hers."

There are two types of people in the world, the rich and the rest of us, and the rich quite often don’t work for a living. Whitman, for example, doesn’t have a day job. She pays the bills with the money she makes by investing the billion dollars or so that she racked up working at eBay.

Actually, she probably doesn’t invest much of it herself these days; she hires someone else to do that. Which means she doesn’t do anything at all to earn the money that comes in each week.

That income is called capital gains — and the HuffPo estimates that she’s bringing in enough that she’d probably owe the state about $4 million a year in taxes at current rates. If she gets elected, and manages to repeal the capital gain tax, she won’t pay any taxes on that money at all.

Which means the state will be even more broke — or that the rest of us suckers, who actually go to work every morning, will have to pay more to make up for it.

I suppose next she’ll want to deregulate the banks.

Repairing the initiative process – in CA and SF

OPINION I recently participated in a research trip to Switzerland to study the alpine nation’s system of direct democracy (initiative and referendum, or I&R). Its model offers fresh ideas about how to repair the dysfunctional initiative process in California and San Francisco.

In California, it takes approximately 750,000 signatures to put a constitutional amendment on the ballot — almost 3 percent of the statewide population — and about three-fifths that for a nonconstitutional statute. That’s an extremely high threshold, so in actual practice the only players able to qualify a ballot initiative are wealthy individuals or organizations that can pay an army of circulators about $3 per signature. It has been years since a statewide initiative has qualified through the work of volunteers.

Because of these dynamics, direct democracy in California has been captured by wealthy special interests. Proponents of Proposition 14, which was bankrolled by Gov. Arnold Schwarzenegger and big business, outspent opponents by 50:1 to pass a “top two” primary that is deform masked as reform. Even when Big Money’s measures lose — as PG&E’s Proposition 16 did — they force everyone else to play defense. Ironically, this dynamic is the opposite of that envisioned by California Gov. Hiram Johnson, who in 1911 created the initiative to allow the people to counter powerful special interests like railroad tycoons.

But in Switzerland, the political leaders have crafted an impressive practice that fosters a noisy collaboration between the people and their elected representatives. That nation has a proposal-counterproposal system. Once an initiative or referendum qualifies for the ballot, the government is given a chance either to pass that law itself or put a counterproposal on the ballot. Similarly, if the government passes a law, the people can put their own counterproposal on the ballot or try to overturn the law via a referendum.

This dynamic unleashes a process that is less polarizing and fosters a healthier debate. That in turn fosters more of an ongoing dialogue between the people and their elected representatives that, over time, forges a broader consensus on issues.

But a key reason this dynamic works is because the Swiss only require about 100,000 signatures for an initiative — a bit more than 1 percent of the population — and 50,000 for a referendum. The Swiss also allow a longer period of time for collecting those signatures, up to 18 months, compared to only five months in California. So non-wealthy interests can use the I&R process and signatures can be gathered with all-volunteer labor.

Gathering 1 percent is still a sizable undertaking; it would equal about 370,000 signatures in California for a constitutional amendment. But that’s low enough that serious efforts lacking deep pockets could still play in the game.

For example, look at the Jeff Adachi-led initiative over public pensions in San Francisco. Adachi has put his fingers on the pulse of an issue that needs addressing, but many progressives feel that the details in Adachi’s measure are too harsh and polarizing. But what if a counterproposal was put on the ballot, giving the public another choice? The subsequent multichoice campaign would be less polarizing and could help find the sweet spot of consensus.

The Swiss model isn’t perfect. Like California, when it comes to the actual I&R campaigns, Switzerland has inadequate campaign finance and transparency laws. With no public financing for underfunded campaigns, private money dominates and skews the public debate.

That’s why free media time should be provided for all significant viewpoints. And shared financing for all campaigns, pro and con, should be considered; all campaigns would be required to pay 15 percent of the amount they spend on their own campaign into a common fund that is distributed to the underfunded campaigns.

Congress is acting stupidly

AFL-CIO President Rich Trumka has it right. It’s not the heat in Washington, D.C., that’s bothering him and many other advocates of working people. It’s the stupidity – the economic stupidity of Congress refusing to give financial aid to states that badly need help in order t o save the jobs of some 300,000 teachers, nurses, firefighters, police and other public service workers who are facing layoffs because of budget deficits.

The possible remedy is at hand – a pending $100 billion jobs bill.  Most of the money would go to states for quickly creating or saving up to one million jobs in public and private employment, restoring government services that have been cut, and averting other planned cuts, mostly in education, public safety and job training.

Republican opposition has kept the jobs bill from passage. The GOP also opposes a companion bill that deals with another bit of economic stupidity in Washington – the stupidity of Congress’ refusal to extend the unemployment insurance benefits of the 1.4 million Americans who will run out of benefits by the end of July, and the 325,000 who already have run out of benefits.

By year’s end, more than eight million workers will have exhausted their benefits. Their regular benefits, averaging $300 a week, ran out after 26 weeks and have not been extended as they usually have been during periods of heavy unemployment. The House voted for extension, and President Obama urged extension. But the Senate has refused to act.

The AFL-CIO’s Trumka calls the situation tragic, as well he should. He notes that almost 15 million Americans are currently unemployed, a number that’s been growing by about 250,000 workers per week.

So, 15 million people who need jobs – many who desperately need jobs – are unable to find them. About one million have been jobless for more than a year.

Overall, the jobless make up about 10 percent of the workforce. They’ve been out of work an average of 35 weeks. Another 11 million Americans are underemployed, including temporary and part-time workers and others who are underutilized and underpaid.

Nearly half of all the jobless have been out of work for more than six months.  As Trumka says, “Families are stretched to the limit and state budgets are under incredible strain, putting hundreds of thousands more jobs in danger. Yet the Republicans in Congress repeatedly have blocked efforts to take action, create jobs and rebuild our battered economy.” Although it’s mainly Republicans who’ve opposed extension of benefits, some conservative Democrats have also opposed extension.

Trumka, noting that many politicians, including every member of the House, will be on the ballot in the coming mid-term elections, urges union members to demand that the office seekers take concrete action to “rebuild our economy and create jobs now.” If they don’t take action, Trumka warns, “they may not be elected officials anymore.”

New York Times’ columnist Paul Krugman blames Congress’ failure to provide relief to the jobless on “a coalition of the heartless, the clueless and the confused.”

Krugman defines the heartless as “Republicans who have made the cynical calculation that blocking anything President Obama tries to do – especially anything that  might ease the country’s economic problems – improves their chances in the midterm elections.

And the clueless? Try Sharron Angle, the Republican candidate for senator from Nevada. She’s repeatedly claimed that the unemployed are deliberately choosing to stay jobless so they can keep collecting the benefits of a few hundred dollars a week.

The confused include politicians and others who apparently are too confused to understand the obvious – that the unemployed need money, and will quickly spend whatever they get in the way of extended benefits, thus boosting consumer spending, helping create jobs quickly and otherwise expanding the economy.

Except to the heartless, clueless and confused, saving money at the expense of the unemployed by denying them benefits is, as Paul Krugman says, “cruel as well as misguided.”
