"It was really all about trust," says Stephanie Foster of Church Street Flowers, when asked about the benefits and perils of transferring ownership of the delightful bouquet boutique — and perennial Guardian Best of the Bay winner — near the Castro to the employees. Foster, along with Rachel Shinfeld and Brianna Foehr, took over in December 2008 from previous owners Michael Ritz and Thomas Teel, who’d run the shop for a decade. "The three of us had worked here for a while and we knew our stuff, so Michael and Tom knew they could rely on us to preserve the legacy. And the outpouring of support from our neighbors and regular customers has been overwhelming."

The ownership change of the cozy shop, bursting with vibrant blooms and friendly energy, went off without a hitch. "We were part of the lucky few who received a small business loan before the economic collapse," Shinfeld says. "But our business plan was smart, and the bank saw that we knew what we were doing." And, even in the current climate, business is thriving. "Our arrangements aren’t your standard cookie-cutter stuff," Foster says. "People nowadays want personalized, reasonably priced, green-minded, and locally sourced. We fit into all that — most of our flowers are from the downtown flower market and we keep an eye out for organic. Plus we strive to create a real connection with our customers, so we can give them exactly what they want."

"Sure, there have been some adjustments," Shinfeld adds. "There’s a lot of paperwork — and the first thing we needed to tackle was a Web site redesign. But our experience working here helped us through, and I think we’re just beginning to blossom in our new roles." (Marke B.)

What is the special ingredient that transforms a business from just another store into a place that makes people feel inspired and connected? After 42 years as a San Francisco independent bookseller, Green Apple Books and Music seems to have found it. Located on Clement Street in a building that predates the 1906 quake, it’s a "big, sprawling, dusty and funky new and used bookstore," as co-owner Pete Mulvihill describes it, creating an atmosphere for interactions that might seem impossible in a big-box store. Several weeks ago, for instance, a customer approached the store clerks, presented a CD, and requested that they play it. He also asked them to clear out the philosophy room. "I want it to myself for just a minute," he explained. The staff complied, the music started, and the man whisked his girlfriend into the philosophy room and proposed to her.

"To me, that’s an honor that somebody loves the place so much that they would propose to their girlfriend here," says Mulvihill, one of three owners and an employee for more than 15 years. A founding member of the San Francisco Locally Owned Merchants Alliance, he has been at the forefront of a push to identify and promote the city’s small, independent businesses. "Locally-owned businesses recirculate more money in the local economy than national chains," the SFLOMA Web site points out.

CHAIN ALTERNATIVE AWARD

HUT LANDON

Hut Landon is responsible the past few years for helping direct millions of dollars into small business in San Francisco and beyond, and millions more into the local economy.

He does it through his energetic and creative leadership of two key organizations that promote the interests of locally-owned small business. Landon has been the executive director of the Northern California Independent Booksellers Association (NCIBA), which promotes the interests of 200 independent bookstores in the region. He is also executive director of the San Francisco Locally Owned Merchants Alliance (SFLOMA).

Under Landon’s stewardship, the two groups commissioned a pioneering 2007 study that quantified the value of locally-owned businesses in the city. Their stunning finding: if consumers redirected l0 percent of their retail purchases from chains to locally-owned merchants, the result would generate about $200 million for the economy, l,295 jobs, and $72 million new income for workers.

Landon’s timing could not have been better. As the economy tanked, local merchants and neighborhood business organizations used the l0 percent consumer shift as a mantra. The study also pointed out that the local economy could get another big boost if the city would shop locally with the tens of millions it now spends outside the city for goods and services.

Landon likes to use the example of two brothers who live together. One works on Potrero Hill and eats lunch at one of the many locally-owned restaurants. The other works at Stonestown shopping center and eats at a chain restaurant because that’s all there is out there. The Potrero Hill money, he points out, stays in the community. SMALL BUSINESS ADVOCATE

Small business owners often feel as if they don’t have many advocates at City Hall. But they do have Regina Dick-Endrizzi.

Dick-Endrizzi, acting director of the Small Business Commission, has been moving rapidly on ways to help small businesses feel more comfortable dealing with the city — and to help them thrive in a tough economic environment. She helped establish the Small Business Assistance Center, which guides local merchants and prospective entrepreneurs through the thicket of city regulations. "It’s a tremendous asset," she told us. "When people walk through the door, we can take the time to help them develop a roadmap to doing business here." And she’s a driving force behind the Shop Local campaign, which will launch this month with bus shelter and bus-side ads designed to encourage San Franciscans to keep their money in town (co-sponsored by the Guardian).

Known in political circles as a former aide to Sup. Ross Mirkarimi, Dick-Endrizzi has a solid background in business. She moved to San Francisco in 1986 to open the Haight Street Buffalo Exchange store, and worked with that company for 13 years. "We bought our inventory from local people, and I had to have a close relationship with local small businesses," she said. "I have an intimate understanding of what it takes to run a business."

After several years in Mirkarimi’s office, she learned of the opening at the Small Business Commission, and plans to stay there for a while. "I truly believe in what this department offers to small business," she said. "There’s such a tremendous need." (Tim Redmond)

URBAN SOLUTIONS

Urban Solutions has its roots in the South of Market Foundation, an economic development corporation formed in 1992 in response to what SoMa merchants, residents, and community-based organizations felt was a lack of accountability in their neighborhood’s development.

A decade later, the organization changed its name and Urban Solutions was born. Two years after that, the burgeoning nonprofit opened a second office, this time in the Western Addition, becoming an important source of service in both neighborhoods.

Urban Solution’s executive director Jenny McNulty says she is currently excited about her organization’s Green Business initiative, which helps educate small business on how to conserve resources and reduce their carbon footprints — and save money in the process.

McNulty is also amped about Urban Solution’s effort — undertaken with the San Francisco Redevelopment Agency — to revitalize Sixth Street’s commercial corridor.

"We’re expanding our Green Business Initiative program, which offers free consulting to help small businesses go green by implementing cost-saving practices to increase the sustainability of their business operations," McNulty said.

Urban Solutions’ Sixth Street revitalization effort includes beautifying the area and helping businesses, in conjunction with Redevelopment Agency grants, by improving their facades, installing new awnings, repainting buildings, and replacing windows, storefronts, and entrance ways.

Jens-Peter Jungclaussen had a dream: Buy a gutted, camouflage-painted school bus on eBay, convert it to biodiesel, and put it to use as a mobile classroom by day and a party on wheels by night, a rollicking omnibus of education, culture, and sustainability. With a few flicks of his wrist, Jungclaussen, a former German windsurfing pro and biology and PE teacher, transforms the bus to suit the need at hand — pulling down a movie screen from the roof; unpacking a buffet table, wet bar, or set of turntables from beneath the seats; or simply switching on the "party lights." Dubbed das Frachtgut ("the good freight"), the bus has hosted dinner parties on Twin Peaks, ecology classes in Muir Woods, sunrise raves on undisclosed beaches, and screenings of The Big Lebowski (complete with bowling and White Russians). It also serves as a mobile billboard for its various local, eco-friendly sponsors and can be rented for field trips and corporate events.

The ever-enthusiastic and tireless Jungclaussen recently turned his attentions to youth education, this year offering for the first time a "mobile summer camp." Teaming up with fellow teachers Michael Murnane, Gretchen Nelson, Justin Ancheta, and Leah Greenberg, he’ll present three, 11-day sessions on wheels that will introduce young people to a variety of Bay Area natural, artistic, and historical treasures. But don’t worry, the parties will still keep rolling. As Jungclaussen promises of the bus, "What you want it to be, it will become." (Marke B.)

ARTHUR JACKSON DIVERSITY IN SMALL BUSINESS AWARD

It’s easy to assume that the purpose of Chillin’, the brainchild of Mexico City native Irene Hernandez-Feiks, is simply to have a good time. But the multimedia parties Hernandez-Feiks has been throwing for 11 years are much more than entertainment. Their actual purpose is to stimulate the economy and support one of the most difficult small businesses to sustain: the business of art.

A former designer herself, Hernandez-Feiks started out organizing weekly happy hours at 111 Minna where she would feature up to five independent Bay Area designers. Her philosophy? Charge the designers nothing for the opportunity and take no commission. The formula worked so well that Chillin’ eventually grew from weeknight happy hours to Saturday night events, complete with DJs. Now Chillin’ is a full-fledged happening — indeed, the June 13 anniversary show at Mezzanine features 180 photographers and artists, 40 filmmakers, 80 fashion designers, and 12 DJs.

But watching Chillin’ grow — and seeing participating artists transform themselves from local to international names — isn’t enough for Hernandez-Feiks. She also devotes much of her time to charity work, including involvement with Gen Art, the Mexican Consulate Cultural Affairs division, the United Nations and Natural World Museum, and the Art Seed Apprenticeship Program benefiting Bayview- Hunters Point youth.

Great expectations?

Equality has been achieved: this recession is kicking everyone’s arse. But I couldn’t help but squirm at a few recent music-biz disjunctions. How does one reconcile the scene at a South by Southwest "Great Expectations" label panel last month, listening to Tony Kiewel describe 2008 as one of the Sub Pop’s best years, with the bad news from Touch and Go’s Chicago HQ a week later? After shuttering its distribution — which once supported imprints ranging from Drag City to Estrus — in February, the 25-year-plus label laid off its entire staff. Owner and ex-Necros bassist Corey Rusk was going to run the enterprise solo.

A second major blow, especially when one considers Touch and Go’s history releasing important discs by Big Black, Scratch Acid, Die Kreuzen, Slint, Jesus Lizard, and of course, the Butthole Surfers (though the label’s 1999 loss in a legal battle with that band likely hasn’t helped). "Touch and Go basically allowed Merge to exist as something other than a singles label," Mac McCaughan of Merge Records stated in February. "If a company that did everything the right way can’t survive in this environment, then who can?"

Are these simply the latest surges and sucks of free-market capitalism’s death throes and toilet-bowl flows? And what’s the state of independence for local labels eking it out in this still-roiling stew of sorry economic news?

"The black and white fact is that [Sub Pop] is not Touch and Go," opines Cory Brown, owner of Bay Area independent Absolutely Kosher and general manager of Misra Records. He notes that Sub Pop is partially owned by Warner Bros. and that Touch and Go had the tough luck of losing some of its biggest artists, including TV on the Radio, Blonde Redhead, and the Yeah Yeah Yeahs. Those departures "all went down not very well," says Brown, who believes Touch and Go’s contraction was "as much an emotional decision as a business one," considering the company had big releases by Pinback and Three Mile Pilot planned.

Rusk declined to comment, although one wonders what will become of his label’s newer bands, among them the Bay Area’s Mi Ami and Sholi. Still, should he strike up a new alliance, all systems could be go at Touch and Go once again. As Brown puts it, "Geoff Travis has closed Rough Trade multiple times now and come back with it."

What of the local label landscape? Lookout! and Jackpine Social Club have ceased new releases, whereas Tigerbeat6 and Anticon have left town. Slumberland is surfing a twee rock revival, and hip-hop’s SMC has taken on bigger fish like Killer Mike. As newbie Bright Antenna appears on the horizon, veterans such as Alternative Tentacles, Fat Wreck Chords, Runt/Water, Quannum Projects, Birdman, Daly City, Dirtybird, and Hook or Crook are staying alive. AT celebrates its 30th anniversary this year. "As music and media become increasingly accessible instantly from anywhere, the role of curator is more important than ever – if I can access 10 millions songs instantly from my phone, how do I choose?," Isaac Bess, director of business development at SF’s IODA (Independent Online Distribution Alliance) writes via e-mail.

Business is bright, thanks to smart planning, for SF distributor Revolver USA and Midheaven Mailorder, which supports labels such as Gnomonsong and DiCristina Stair Builders. "We’re doing well, and I think that has a lot to do with what our expectations are, and not looking for a big record to be carried by Walmart and Target," says general manager Mike Toppe, who thinks it’s more important to "keep connecting with people who are passionate about music."

Fat Mike, who started Fat Wreck Chords to put out music by his bands NOFX and Me First and the Gimme Gimmes, has a more hardcore perspective. "In the ’90s, every fucking band we signed sold a shitload of records and got popular all over the world. It was ridiculous," he e-mails from NOFX’s current European tour. "Now only the really good bands can sell a decent amount. That’s okay, though. This industry collapse is mostly killing mediocre bands." As for the decline in CD and recorded music sales, the SF road warrior believes that’s not going to stop: "The record industry party is over, but great live bands will always do okay."

But what about the groups that can’t pick up blogosphere buzz? Both Jacobs and Brown acknowledge the difficulty in developing emerging or even mid-level bands via traditional avenues. Add in the complicating factor of so-called 360 deals, in which a label takes a percentage of all artist revenue in exchange for promotion, and you have what Brown calls a "destructive" outlook. "The bottom line is musicians should get paid," he said. "Forget about how labels are doing — how are musicians doing in this climate?

"I think new ideas really have to come into play, and those have to be based on the quality of life for the musician, not the company that comes up with an application," he continued, touching on the lack of public funds for musicians and lack of official recourse for bands if, for instance, they don’t get paid by a club. "It’s basic stuff, but it’s harder to look past those things. It has to go back to the content provider."

I hate the Master Cleanse.

Fighting against our bodies to make them do what we want is counterproductive. Instead, if you cultivate better communication with your body’s needs and reward yourself when it does what you want, you’ll find you’re more in control of your health.

Detoxing can be a beneficial part of doing this, and I have reaped many benefits from raw vegan detoxes. But contrary to popular belief, I think the Master Cleanse does exactly the opposite.

For those who don’t know, the Master Cleanse is a program in which you drink a concoction of water, lemon, maple syrup, cayenne pepper, and sea salt — exclusively — for anywhere from three to 30 days. The cleanse was recently made popular stars like Beyonce as a last-minute way to look good on the red carpet. But some experts say that the cleanse can do more harm than good.

One issue, says Carolynn Kraskouskas, owner and operator of Be Whole Again! Bodywork and Nutritional Therapy (Be Whole Again!, 3150 18th Street Mlbx 511, Suite 536, SF; www.bewholeagain.net), is that cleansing is supposed to allow your organs to rest and rebuild themselves. But the average person doesn’t eat a healthy enough diet to sustain itself during the Master Cleanse. Therefore the diet creates a system where the body doesn’t think you will treat it right, throwing the internal balance off. “For most people who are sick, run-down, tired, or stressed out, it simply stresses the system out more, creating inflammation and a rise in the pH of a person,” she said. This can create an acidic environment that, she says, is the basis for all disease.

So what’s the alternative? Many experts recommend raw juice cleansing or fasting. (Juice is considered raw when it comes from fresh fruits and vegetables, never frozen or pasteurized.) Some say a juice fast can diminish the ill effects of fatigue, skin issues, headaches, insomnia, weight loss and gain, and more.

But what of the lemons used in the Master Cleanse? Cherie Calbom, the “Juice Lady” on Raw Vegan radio (www.rawveganradio.com) admits these do provide some pH regulation and antioxidants, but not enough to deal with the amount of toxins being released during the cleanse. “If you don’t have antioxidants to bind to those toxins, they can do tissue damage,” she says. “Vegetable juice fasting is a much healthier way to go. Antioxidants bind the toxins and carry them out of the body.”

The toughest part about a raw juice fast is that the juice is extremely perishable and should be drunk immediately. There are steps you can take to store fresh juice for up to 24 hours, but, as you can imagine, this could be a full-time job. We’ve assembled a list of places in the city that can help you maintain a healthy juice fast while still having a life. Some places, like Juicey Lucy’s, even provide personal consultations to determine the best cleanse for you and then deliver a full, raw, seasonal, organic juice cleanse to your door three days a week. And don’t forget that even if you’re not fasting, fresh juices are a healthy — and delicious — addition to any diet.

GREEN CITY When U.S. Secretary of the Interior Ken Salazar looked out at a sea of faces during a San Francisco public hearing April 16, a band of activists dressed as polar bears, sea turtles, and other marine creatures stood out from the rest. Their message, also articulated by a host of federal and state-elected officials, was unequivocally clear: no new oil and gas drilling off the California coast.

Waving a thick document in the air, Salazar explained that he’d inherited a five-year plan from the Bush administration to award new leases for oil and gas drilling in the federally controlled outer continental shelf, which comprises some 1.7 billion underwater acres off the Atlantic and Pacific coasts, the Gulf of Mexico, and Alaska.

Rather than move the policy as planned, Salazar extended public comment for six months, met with stakeholders in each region, and placed greater emphasis on developing offshore renewable energy. The San Francisco public hearing was the last in a series of four that Salazar attended.

"One of the significant issues that is so important to President Obama is that we move forward with a new energy frontier," Salazar said. He advocated embracing offshore wind and other renewable alternatives as part of a "comprehensive energy plan going forward." Yet Salazar also indicated that future plans for the nation’s energy mix were "not to the exclusion of oil and gas," and mentioned that opportunities for "clean coal" technology should also be considered.

Under the five-year plan, three new leases are proposed off California’s coast — two in the south, and one in the Point Arena Basin, an underwater swath near Fort Bragg. Elected officials unanimously opposed any new offshore petroleum development. "Our state clearly is saying to you today, no," declared Sen. Barbara Boxer, chair of the Senate Environment and Public Works Committee. "Instead of putting our California coast and economy in jeopardy, we need to look at … green technology which will bring us new jobs."

Lt. Gov. John Garamendi sounded a similar note, saying the billions that would be invested in offshore oil could be put toward advancing clean energy. Rep. Lynn Woolsey (D-Petaluma) highlighted the risk of oil spills around the Point Arena Basin. "It could be turned from a wellspring of life into a death plume," she said. "This shimmering band of coast must be protected."

While nearly every testimony blasted new offshore oil development, the conversation brightened when Salazar asked for comments on renewable energy. According to estimates by the National Renewable Energy Laboratory, offshore wind in shallow areas could provide some 20 percent of the electricity needs of coastal states nationwide. Wave energy, while still under study, might one day generate enough electricity to power some 197 million homes per year, according to Department of the Interior estimates.

Most of the oil that could be extracted from the outer continental shelf would come from the Gulf of Mexico and Alaska, with some 10 billion barrels potentially available off the Pacific coast. Joe Sporano of the Western States Petroleum Association said offshore drilling could create jobs and limit dependence on foreign oil. Yet Boxer pointed out that, based on Energy Information Administration figures, drilling for oil across all areas would yield just 1 percent of the nation’s total oil consumption by 2030 — and it’s not believed to make a real difference in gas prices.

Richard Charter, government relations consultant with Defenders of Wildlife, seemed confident that California’s coast would be protected. "You have a new interior secretary for an administration that received California electoral votes … in a state that is pretty much single-minded in its position in terms of saving the coast," he said.

Charter’s optimism was helped by a recent federal appeals court ruling against the previous administration’s plan to award new offshore-drilling leases in the Arctic.

So now, "whatever Secretary Salazar does will have his own stamp on it," Charter said. "In each of these hearings, it’s become apparent that the Obama administration may be coming around to a new approach."

Public comment for the offshore leasing plan ends in late September. Salazar told reporters that he expects a decision by the end of the year.

As San Francisco’s party season gets underway — a time when just about every weekend includes street fairs and festivals, venerable celebrations like Bay to Breakers, quirky cultural events such a flash mobs, promoter-created club nights, and underground parties designed to raise funds for Burning Man camps and other endeavors — police and other party-poopers keep finding new ways to crack down on the fun.

The latest: potentially fatal price gouging of the How Weird Street Faire, a series of bizarre police raids on underground clubs, and state alcohol officials threatening to yank local club licenses.

For years, the Guardian has been warning that NIMBY neighbors, intolerant enforcers, and indifferent city officials were threatening the vibrant social events that make San Francisco such a fun and unique city (see “Death of fun,” 5/23/06, “Death of fun, the sequel,” 4/25/07, and regular recent posts on the SFBG Politics blog).

Lately the situation has gotten so bad that even the conservative San Francisco Examiner has written about the problem (“Squeezing the fun out of festivals,” 4/13/09) and followed it up with an editorial calling for city officials to address the issue and ensure that the cultural events can keep happening.

Overwhelming public opposition to recently proposed restrictions on the May 17 Bay to Breakers and April 12 Bring Your Own Big Wheel events led City Hall to pressure the San Francisco Police Department into reversing promises of a crackdown, although many events are being threatened.

The How Weird Street Faire is scheduled for May 10, although organizers say they can’t come up with the nearly $10,000 the San Francisco Police Department is demanding by May 1. Organizer Brad Olsen sought help from City Hall (Sup. Ross Mirkarimi and senior mayoral aide Mike Farrah — who helped save BYOBW — have both tried to intervene, so far to no avail) and unearthed city codes that seem to cap police fees for events like How Weird at $5,494, but the cops haven’t budged.

“Although we appreciate your position, it would be unwise for the SFPD to risk public money by not collecting the required fees prior to the event. If the event is the only way your group is able to pay for police services, we are all betting that the event will be as successful as you hope,” SFPD Lt. Nicole Greely wrote to How Weird promoters on April 13, suggesting that organizers take out a loan to pay the escautf8g protection money demanded by SFPD.

But Olsen said his grassroots group, which barely breaks even on the event, has never in its 10-year history been required to pay in advance and told us that entrance donations at the event are the only real source of revenue for the popular dance party.

Meanwhile the Guardian has heard multiple reports of undercover cops infiltrating underground parties in SoMa in the early morning hours of April 11 and 12, followed up by groups of more than a dozen uniformed officers storming in and roughly making arrests for resisting arrest, illegal alcohol sales, and drug possession.

“All of a sudden an undercover cop just tackled someone on the dance floor,” 27-year-old San Francisco resident Ryan Parkhurst told us, describing the scene at one party. “Then at that point, more than 10 officers came upstairs … I asked an officer, ‘What’s going on?’ and he said, ‘Arrest this guy.'”

Parkhurst said four cops then jumped on him, roughed him up, and arrested him. “Another guy was beat up worse than I was, with severe bruises and scratches all over his face.”

Parkhurst said he was charged with being drunk in public, resisting arrest, and assaulting an officer, but when he went to court on April 13, he was told all charges had been dropped.

SFPD spokesperson Sgt. Lyn Tomioka spent several days trying to gather information on the raids, but had little to offer by Guardian press time. “I can’t give you the answers you’re looking for based on what the computer is telling me,” she said. The District Attorney’s Office also did not respond by press time.

The attention that the California Department of Alcoholic Beverage Control (ABC) is paying to licensed venues seems to have ratcheted up lately as well. DNA Lounge, a nightlife haunt for freaks of all stripes, was cited by ABC in February for operating “a disorderly house injurious to the public welfare and morals” after undercover agents for the department witnessed brief instances of nudity and simulated intercourse during the DNA’s popular regular queer parties Cream and Escandalo.

These instances occurred during go-go and stage routines, mostly involving flashing buttocks and a wet T-shirt contest. In a statement on the DNA Lounge Web site , www.dnalounge.com, DNA owner Jamie Zawinski contends that ABC is retaliating against his club for appealing the department’s decision not to grant DNA a conversion of its license from a Type 48 (21-and-over bar) to a Type 47 (all-ages venue that serves food). During the appeal process, a settlement was reached, and the DNA successfully converted its license.

“As a direct result of our having filed an appeal, ABC began sending undercover agents into the club during our gay and lesbian promotions looking for dirt,” Zawinski writes, drawing attention to the specific targeting of DNA’s queer nights, a particular that inflamed the gay community when a story about it was published in the Bay Area Reporter.

It is the specific requirement that all-ages venues collect 50 percent or more of their revenue from food sales that has gotten several other San Francisco clubs in trouble with ABC. The state requires that venues possessing a Type 47 (“bona fide eating place”) license, a requirement for most all-ages clubs, earn just as much revenue from food sales as liquor sales. That’s particularly daunting for businesses that have traditionally made most of their money at the bar.

“There is grave concern and fear,” San Francisco Entertainment Commissioner Terrence Alan told the Guardian, “that the recent conflicting and oftentimes underground regulations [of ABC] could undermine the great and ongoing work of the Entertainment Commission and Sup. Ross Mirkarimi’s proposed cultural legislation.”

Alan was referring to the “Promoting and Sustaining Music and Culture in San Francisco” charter amendment sponsored by Mirkarimi that would “produce a master plan and vision that promotes a sustainable environment for music, culture, and entertainment throughout the city.”

It appears the law enforcement types are doing everything possible to make sure Mirkarimi’s vision never becomes reality.

In 1984, journalists Milton Moskowitz and Robert Levering published a landmark book called The 100 Best Places to Work for in America. I didn’t want to work for any of them. The list is updated every year through the San Francisco-based Great Places to Work Institute, and it runs in Fortune.

The institute looks at things like pay, benefits, and perks, as well as at trust and culture: Does management accept input freely? Are workers in involved in key decisions? Do people feel part of a team? All of these are important factors in a workplace.

But the selection process doesn’t look at what the company actually does.

For example, Texas Instruments is on the list. It’s also a defense contractor that makes precision-guided weapons systems. You know, bombs. Starbucks — the voracious chain that drives out small local coffee shops — is on the list. So is Whole Foods and Microsoft and Goldman Sachs.

I’m not saying that Levering, who runs the institute, isn’t doing good work. But when you talk about great places to work these days, I think you also should be talking about places that have a positive impact on the environment.

The world is facing two cataclysmic crises these days. The planet is melting down. So is the economy. The only way we’re going to fix both is to look at economic development that is also environmental development. And a lot of it is going to happen in cities.

Real sustainable development includes green jobs (Bay Area activist Van Jones is bringing that agenda to the White House) — and a commitment to preserving locally-owned, independent businesses and a diverse community.

Those aren’t conflicting goals, they’re complimentary. But looking only at one piece of the puzzle — how many jobs we create, or how nice they are — isn’t going to get us where we need to go. *

EDITORIAL Here’s a snapshot of the state of green San Francisco, as we approach Earth Day 2009:

San Francisco ought to be getting $18 million a year for energy-efficiency programs, but the money instead goes to Pacific Gas and Electric Co., which is wasting half of it.

Mayor Gavin Newsom went to Washington, D.C. to participate in a Newsweek panel on the environment and called for a transformation of the American automotive industry just a few days after the city’s transportation agency decided to cut $56 million out of Muni, increase transit fares by $30 million — and hike fees for car parking by just $11 million.

The city stands to get millions in federal stimulus money for green jobs — but nobody knows how many jobs the money will create, where they will come from, or who will get them.

This doesn’t seem the best way for one of the most liberal cities in America to respond to the environmental and economic crisis.

As Rebecca Bowe reports on page 10, PG&E is managing part of a multibillion dollar program aimed at cutting electricity demand. It’s a laudable goal — in fact, the cheapest way to reduce the use of fossil fuels and dirty power is to use less in the first place.

But the private utilities are a bad fit for any program that seeks to cut demand. Every year PG&E tells Wall Street how it expects to grow — and since the company’s product is electricity and natural gas, that means PG&E has no incentive at all to shrink its market. Not surprisingly, the giant utility has done a crappy job of running the program, failing to meet even its modest goals.

But state law allows cities to apply to run the local programs themselves — and data from across California show that public sector, non-utility programs do a far better job of lowering electricity use. So why isn’t San Francisco applying for that money? Because the San Francisco Public Utilities Commission thinks it’s "premature."

That’s crazy — the money could create local green jobs, reduce energy demand, and cut PG&E waste. It’s an obvious choice, and the supervisors should pass a resolution directing the PUC to take on this program.

The supervisors no longer have control over Muni fare hikes, but when they examine the city budget, they should take a hard look at what Newsom’s transit planners are doing. Cutting bus service during a recession, when low-cost transportation is needed more than ever, is generally a bad idea. So is raising Muni fares. Why are the car drivers, who are generally richer (and many of whom are commuters from wealthier suburbs) getting off so cheap?

The supervisors also need to be monitoring closely the federal stimulus money and the creation of green jobs. The single most important thing San Francisco can be doing right now is creating jobs in the green economy. In fact, there ought to be a city loan fund just for local green-collar startups. Instead, while Newsom is prancing around the country running for governor, his staff seems flummoxed by the whole process. The city needs a goal — say, 5,000 new green-collar jobs for unemployed San Franciscans in the next five years — a plan to create them, and a program to use the available federal money.

Newsom seems to have plenty of ideas for Detroit. We’d love to see him start to focus on San Francisco. *

A Q&A with Nick Cave

Nick Cave and I probably crossed paths in Heaven one night. Heaven was a club on Woodward Avenue in Detroit where you could go, after 2 a.m., to dance and sweat and lose yourself to the sounds of DJ Ken Collier. Cave’s time in Heaven has made it possible for him to create “Meet Me at the Center of the Earth,” his show at Yerba Buena Center of the Arts. Time spent in that kind of cathartic, uninhibited place is necessary for someone — someone like Cave — to bring people to the Earth’s core and allow them to begin reimagining from the center of existence. When Cave and I talked on the phone recently, the morning of a full-page profile of him appeared in the Sunday New York Times, our discussion started near Heaven, and ended in Barack Obama’s Chicago.

SFBG How has your studio changed over the years, in terms of location, layout, and contents?
Nick Cave My studio has changed according to the way my career has changed. I’ve expanded in space due to demand. I’ve had to bring on more studio assistants. It’s evolved and grown, but without expanding beyond my means. I look at it the same way I did when I had a clothing store. I try to make smart moves.

SFBG Do those things influence your process, or do many of your ideas originate outside of the studio space?
NC I think it does occur outside the studio space. The studio is where the ideas are manifested. The ideas come from being out there in the world — just being open. Though sometimes a revelation may happen in the studio, based on an experience I’m developing. It happens when it happens.

SFBG We’ve both spent formative time in Detroit and the Detroit area. I went to Wayne State [University], while you went to Cranbrook Academy of Art]. I’d love to know more about your experience there with [fiber artist and teacher] Gerhardt Knodel. I wondered also whether you had ties to the club scenes in Detroit or Chicago at any time.
NC Oh, hell yeah [laughs].
Cranbrook was probably the most extraordinary place for me. I could have gone straight to New York [City], or to other schools, but I knew I needed an environment that was somewhat isolated, because of my desires to be distracted by other creative endeavors. Cranbrook provided this amazing intensive rigor and isolation from the world. Yet I had Detroit, which really allowed that gritty balance. It was the best of both worlds. When I needed to get the hell out of Cranbrook, believe me, I did.

Law vs. Justice

City Attorney Dennis Herrera relishes his reputation as a crusading reformer. For several years, his official Web site prominently displayed the phrase "Activism defines SF City Attorney’s Office," linked to a laudatory 2004 Los Angeles Times article with that headline.

"Doing what we can do to ensure civil rights for everyone is not something we are going to back away from," was the quote from that piece Herrera chose to highlight on his homepage, referring to his work on marriage equality. The article also praises the City Attorney’s Office practice of proactively filing cases to protect public health and the environment and to expand consumer rights.

But more recently the City Attorney’s Office also has aggressively pushed cases that create troubling precedents for civil rights and prevent law enforcement officials from being held accountable for false arrests, abusive behavior, mistreatment of detainees, and even allegedly framing innocent people for murder.

Three particular cases, which have been the subject of past stories by the Guardian, reveal unacceptable official conduct — yet each was aggressively challenged using the virtually unlimited resources of the City Attorney’s Office. In fact, Herrera’s team pushed these cases to the point of potentially establishing troubling precedents that could apply throughout the country.

Attorney Peter Keane, who teaches ethics at Golden Gate University School of Law and used to evaluate police conduct cases as a member of the Police Commission, said city attorneys sometimes find themselves trapped between their dual obligations to promote the public good and vigorously defend their clients. "Therein lies the problem, and it’s a problem that can’t be easily reconciled," he told us.

"A lawyer’s obligation is to give total loyalty to a client within ethical limits," Keane said, noting his respect for Herrera. But in police misconduct cases, Keane said, "it is desirable public policy to have police engage in ethical conduct and not do anything to abuse citizens."

RODEL RODIS VS. SF


Attorney Rodel Rodis is a prominent Filipino activist, newspaper columnist, and until this year was a longtime elected member of the City College of San Francisco Board of Trustees. So it never made much sense that he would knowingly try to pass a counterfeit $100 bill at his neighborhood Walgreens in 2003 (see "Real money, false arrest," 7/9/08).

Nonetheless, the store clerk was unfamiliar with an older bill Rodis used to pay for a purchase and called police, who immediately placed Rodis in handcuffs. When police couldn’t conclusively determine whether the bill was real, they dragged Rodis out of the store, placed him in a patrol car out front, and took him in for questioning while they tested the bill.

There was no need to arrest him, as subsequent San Francisco Police Department orders clarified. They could simply have taken his name and the bill and allowed him to retrieve it later. After all, mere possession of a counterfeit bill doesn’t indicate criminal intent.

The police finally determined that the bill was real and released Rodis from his handcuffs and police custody. Rodis was outraged by his treatment, and sued. He insisted that the case was about the civil rights principle and not the money — indeed, he says he offered to settle with the city for a mere $15,000.

"I told my lawyer that I didn’t want a precedent that would hurt civil liberties," Rodis told the Guardian.

To his surprise, however, the City Attorney’s Office aggressively appealed rulings in Rodis’ favor all the way up to the U.S. Supreme Court, which found that the officers enjoyed immunity and ordered reconsideration by the Ninth Circuit Court of Appeals. Last month the Ninth Circuit ruled in the city’s favor, thus expanding protections for police officers.

Rodis can now name cases from around the country, all with egregious police misconduct, that cite his case as support. "Even with that kind of abuse, people can no longer sue because of my case," Rodis said.

Herrera disputes the precedent-setting nature of the case, saying the facts of each case are different. "We’re defending them in accordance with the state of the law as it stands today," Herrera said, arguing that officers in the Rodis case acted reasonably, even if they got it wrong. "We look at each case on its facts and its merits."

Herrera said he agrees with Keane that it’s often a difficult balancing act to promote policies that protect San Francisco citizens from abuse while defending city officials accused of that abuse. But ultimately, he said, "I have the ethical obligation to defend the interests of the City and County of San Francisco."

While it may be easy to criticize those who bring lawsuits seeking public funds, Rodis says it is these very cases that set the limits on police behavior and accountability. As he observed, "The difference between police in a democracy and a dictatorship is not the potential for abuse, but the liability for abuse."

MARY BULL VS. SF


In the run-up to the U.S. invasion of Iraq in 2003, there were months of antiwar protests resulting in thousands of arrests in San Francisco. Activist Mary Bull was arrested in November 2002. Bull said she was forcibly and illegally strip-searched and left naked in a cold cell for 14 hours.

San Francisco’s policy at the time — which called for strip-searching almost all inmates — was already a shaky legal ground. Years earlier Bull had won a sizable settlement against Sacramento County because she and other activists were strip-searched after being arrested for protesting a logging plan, a legal outcome that led most California counties to change their strip-search policies.

So Bull filed a lawsuit against San Francisco in 2003. The San Francisco Chronicle ran front page story in September 2003 highlighting Bull’s ordeal and another case of a woman arrested on minor charges being strip-searched, prompting all the major mayoral candidates at the time, including Gavin Newsom, to call for reform. Sheriff Michael Hennessey later modified jail policies on strip searches, conforming it to existing case law.

But the City Attorney’s Office has continued to fight Bull’s case, appealing two rulings in favor of Bull, pushing the case to the full Ninth Circuit Court of Appeals (from which a ruling is expected soon) and threatening to appeal an unfavorable ruling all the way to the U.S. Supreme Court.

"It’s pretty outrageous and humiliating to strip-search someone brought to jail on minor charges," Bull’s attorney Mark Merin told the Guardian. "If they win, they establish a bad precedent."

Herrera said the case is about inmate safety and that his office must follow case law and pursue reasonable settlements (neither side would say how much money Bull is seeking). "We do it well and we do it with a sense of justice at its core," Herrera said.

Yet Merin said the city’s actions fly in the face of established law: "In the Bull case, he’s trying to get 25 years of precedent reversed."

Merlin noted that "the problem is not with the city, it’s with the U.S. Supreme Court." In other words, by pushing cases to a right-leaning court, the city could be driving legal precedents that directly contradict its own stated policies.

"It would be nice if this city was in a different league, but they look at it like any defense firm: take it to the mat, yield no quarter" he added.

JOHN TENNISON VS. SF


For the Guardian, and for all the attorneys involved, this was a once-in-a-lifetime case. In 1990, Hunters Point residents John J. Tennison and Antoine Goff were convicted of the 1989 gang-related murder of Roderick Shannon and later given sentences of 25 years to life.

Jeff Adachi, Tennison’s attorney and now the city’s elected public defender, was shocked by a verdict that was based almost solely on the constantly mutating testimony of two young girls, ages 12 and 14, who were joyriding in a stolen car, so he continued to gather evidence.

Eventually Adachi discovered that police inspectors Earl Sanders and Napoleon Hendrix and prosecutor George Butterworth had withheld key exculpatory evidence in the case, including damaging polygraph tests on the key witnesses, other eyewitness testimony fingering a man named Lovinsky Ricard, and even a taped confession in which Ricard admitted to the murder.

After writer A.C. Thompson and the Guardian published a cover story on the case (see "The Hardest Time," 1/17/01), it was picked up pro bono by attorneys Ethan Balogh and Elliot Peters of the high-powered firm Keker & Van Nest LLP, who unearthed even more evidence that the men had been framed, including a sworn statement by one of the two key prosecution witnesses recanting her testimony and saying city officials had coached her to lie.

In 2003, federal Judge Claudia Wilken agreed to hear Tennison’s case and ruled that the prosecution team had illegally buried five different pieces of exculpatory evidence, any one of which "could have caused the result of Tennison’s new trial motion and of his trial to have been different."

She ordered Tennison immediately freed after 13 years in prison. The district attorney at the time, Terrence Hallinan, not only agreed and decided not to retry Tennison, he proactively sought the release of Goff, who was freed a few weeks later.

"The only case you can make is that this was an intentional suppression of evidence that led to the conviction of any innocent man," Adachi told the Guardian in 2003 (see "Innocent!" 9/3/03). In the article, Hallinan said "I don’t just believe this was an improper conviction; I believe Tennison is an innocent man."

But the pair has had a harder time winning compensation for their lost years. State judges denied their request, relying on the initial jury verdict, so they sued San Francisco in 2003, alleging that the prosecution team intentionally deprived them of their basic rights.

"What happened to these guys was a horrible miscarriage of justice," Balogh said.

The City Attorney’s Office has aggressively fought the case, arguing that the prosecution team enjoys blanket immunity. The courts haven’t agreed with that contention at any level, although the city spent the last two years taking it all the way to the Ninth Circuit, which largely exonerated Butterworth. The case is now set for a full trial in federal district court in September.

"They are unwilling to admit they made a mistake," Elliot said. "They are doing everything not to face up to their responsibility to these two guys."

The lawyers said both Herrera and District Attorney Kamala Harris had an obligation to look into what happened in these cases, to punish official wrongdoing, and to try to bring the actual murderer to justice. Instead the case is still open, and the man who confessed has never been seriously pursued.

Harris spokesperson Erica Derryck said the Ninth Circuit and an internal investigation cleared Butterworth "of any wrongdoing," although she didn’t address Guardian questions about what Harris has done to close the case or address its shortcomings.

In fact, the lawyers say they’re surprised that the city is so aggressively pushing a case that could ultimately go very badly for the city, particularly given the mounting lawyers’ fees.

"When we filed the case, we never thought we’d be here today," Balogh said. "They had a bad hand and instead of folding it and trying to pursue justice in this case, they doubled down."

Herrera doesn’t see it that way, instead making a lawyerly argument about what the prosecution team knew and when. "Our belief is there is no evidence that Sanders and Hendrix had information early on that they suppressed," Herrera said. "Based on the facts, I don’t think they, Hendrix and Sanders, violated the law. But that’s a totally different issue than whether they were innocent…. It’s not our role to retry the innocence or guilt of Tennison and Goff."

Herrera said he’s limited by the specific facts of this case and the relevant laws. "If the Board of Supervisors wants to do a grant of public funds [to Tennison and Goff], someone can legislate that. But that’s not my job," Herrera said.

As far as settling the case in the interests of justice or avoiding a precedent that protects police even when they frame someone for murder, he also said it isn’t that simple. Keane also agreed it wouldn’t be ethical to settle a case to avoid bad precedents.

"I’m always willing to talk settlement," Herrera said. "This is not an office that makes rash decisions about the cases it chooses to try or settle."

Deputy City Attorney Scott Wiener is the point person on most police misconduct cases, including the Rodis and Tennison cases, as well as another current case in which Officer Sean Frost hit a subdued suspect, Chen Ming, in the face with his baton, breaking his jaw and knocking out 10 teeth.

Wiener, who is running for the District 8 seat on the Board of Supervisors and is expected to get backing from the San Francisco Police Officers Association, recently told the Chronicle that Frost "did not do anything wrong." Contacted by the Guardian, Wiener stood by that statement and his record on police cases, but said, "I consider myself to be fair-minded." He also denied having a strong pro-police bias.

Yet those involved with these cases say they go far beyond the zeal of one deputy or the need to safeguard the public treasury. They say that a city like San Francisco needs to put its resources into the service of its values.

"It raises the broader question of what is the city attorney’s mandate? Is it fiscal limitation regardless of the truth?" Balogh said. "Dennis Herrera has had a very aggressive policy in defending police officers."

Herrera says he is proud of his record as the city attorney, and before that, as president of the Police Commission. "I believe in police accountability and have made that a big part of what I’ve done throughout my career."

A graph on the Mayor’s Office’s newly launched website seeks to break it all down.

So, finally, the Mayor’s Office has launched a website to track stimpack dollars that are coming to San Francisco based on census data (formula funding), or that can be competed for locally.

So far the newly launched website breaks down the dollars by the following categories: public safety, environment, education, housing, health and human services and transportation. It’s a good start.

What the site does not do is break down the dollars according to whether they are going to create green collar jobs. Such jobs been defined by Van Jones, Obama”s new Green Collar czar, as, ” a family-supporting, career-track job that directly contributes to preserving or enhancing environmental quality.”

I realize it’s early days and the city may truly not have a handle on this crucial date yet, and I’m trying to practice what Jones, who likes metaphors involving ships, (the Amistad, the Titanic, and Noah’s Ark all get invoked in Jones The Green Collar Economy,) calls “the Noah principles.

These five principles can be summed up thus: “fewer issues, more solutions; fewer demands, more goals; fewer targets, more partners; less accusation, more confession; and less cheap patriotism, more deep patriotism.”

It’s a pleasure to see Sean McFarland receive the Baum Award for Emerging American Photographers. Last August, McFarland was one of the eight artists or groups showcased in the Bay Guardian‘s second annual photo issue. The Baum Award is a national honor designated for photographers at a pivotal point in their development, and in McFarland’s case, that development is the opposite of predictable. While many photographers work toward "dazzle ’em" displays of technical virtuosity, McFarland has moved away from earlier saturated digital color images toward simple Polaroid photos that possess ominous allure.

Did I say simple? McFarland’s dreamlike images of weather and landscapes are only simple in appearance — they require subtle combinations of photography and the increasingly popular practice of found-image collage. In terms of subject matter, they personalize and miniaturize the vast and unsettling images of the semi-settled West present in the camera art of Michael Light, David Maisel, and Trevor Paglen. The title of Lindsay White’s current show at Ping Pong Gallery, "A Field Guide to the Atmosphere," might just as well apply to McFarland’s work. The atmosphere is stormy, and as troubling as it is beguiling.

SFBG In the last year or two, your work has shifted away from urban views to elemental images: sky, sea, vast land. What has set you off in that direction?

Sean McFarland I’ve been thinking a lot about the ways in which the earth changes. In an urban environment, we build buildings, roads, and parks, changing the landscape. These are immediate and obvious alterations of our environment. Our actions also change the landscape as we alter the climate — more frequent and powerful storms, rising seas. By focusing on making images of the natural world, of the landscape, I’m interested in making pictures of us. How we change the earth and how the earth effects us.

SFBG Your work from the earlier 2005 era reminds me a bit of a short film, site specific_Las Vegas 05, by an artist named Olivo Barbieri. It has amazing colorful aerial views of Las Vegas in which the city really looks like it is comprised of toy buildings and cars. Were you looking for that kind of "making strange" effect when presenting views some might take for granted?

SM The work I was making from 1999 until around 2002 tried to take things that were fake and make them look real. When I first started re-photographing the collages I was making (in 2003), the miniaturization effect was an unexpected but welcome result. I was working in the other direction, making the real look fake. The collages are made by hand, so the edges are rough and messy. The selective blurring of images was there at first to hide where the images were put together, but it was that transformative quality of the focus that made the process intriguing to me. With the collaged images, I was taking pictures from all over, real images of real things, and by bringing those disparate elements together, the pictures raise questions about what was actually in the photograph.

The image of the park (in the Guardian‘s August 2008 Photo Issue), for example, has the playground from Dolores Park, but with the downtown skyline and bridge removed and replaced with a sky from another city. It may be the absence of the urban center normally in the background that makes the picture seem odd, or it could be that the light from the sky is not the same reflecting off the foreground. The relationship between fact and fiction is one of the strongest reasons I work with photography as opposed to other visual art forms.

SFBG You mention collage as a part of your process. That might not be so apparent to someone who casually glances at your photography. Can you tell me a bit about your approach to collage, and also if there are any collage artists whom you especially like?

SM Lately I’ve been working to make the collage process less apparent. In the past, the images took the final form of a C-Print, made in a darkroom. Now I’m using Polaroid film. Polaroids are mementos and souvenirs of moments, places, and things that actually happened; they imply that whatever is in the picture was witnessed, was real. Since I can’t really take the images I’m making, I’m using collage to do so. A good example is my image of the airplane flying over the black ocean and white land. The picture of the plane is taken from a satellite image of Earth, the land is a photograph I made in the Exploratorium (it’s a picture of an exhibit that shows how land is changed by wind currents).

SFBG Books are a big visual inspiration to me, so I liked seeing you cite the Field Guide to North American Weather and Gerhard Richter’s Atlas as two recent sources of fascination and perhaps material. What drew you to those books and what do you like about them?

SM I enjoy those books because they are both wonderful collections. I work from an archive of several thousand images. This is probably why Atlas is so fascinating to me. It’s the source material (mostly photographs) that Richter uses in his work and it made me even more interested in his work. I like the Field Guide because all the pictures in it are of weather-based natural phenomena. Some of the photographs in it are pretty hard to believe, but actually happened.

It may seem odd that the loss of a two-story vacant building would ruffle so many feathers, spur multiple phone calls to the police, and inspire a push from Board of Supervisors president David Chiu to make changes to San Francisco’s building code. But the March 16 demolition of the Little House, a 148-year-old Russian Hill cottage on Lombard Street, struck a nerve and raised a slew of questions — many of which continue to go unanswered.

Controversy may have started swirling because a property that has stood since Abraham Lincoln’s presidency was razed with scarcely a week’s notice on a swiftly issued emergency-demolition permit. It might also have been because the co-owners of the property, Michael Cassidy and James Nunemacher, represent the high-profile Residential Builders Association and the real estate firm Vanguard Properties, respectively — both politically well-connected entities that have been behind projects in the past that drew criticism from various citizens groups.

The Little House, which previously stood at 1268 Lombard St., was by some accounts one of the 10 oldest homes in San Francisco. Under the California Environmental Quality Act, a building of that age would normally require an environmental impact report before the Planning Department can issue a demolition permit. According to Department of Building Inspections spokesman William Strawn, the emergency demolition permit was issued after a structural engineer who had inspected the property on behalf of the owners sent a letter expressing concern that it was in danger of collapse. DBI staffers, including department manager Ed Sweeney, inspected it, and Strawn said the permit process started once they concluded that it presented a safety hazard.

Word that the cottage would be razed sparked an outcry from a group of concerned neighbors and historic preservationists, including architect F. Joseph Butler, who says he discovered it 15 years ago when he learned that it was one of the few structures on Russian Hill to escape the 1906 earthquake and ensuing fires. Butler says he doubts the building was in danger of collapse, and says he tried in vain to convince DBI to allow him to bring in a third party who could offer a second opinion. When asked about that possibility, Strawn said, "The building department would not rely on a third-party source."

The building was torn down March 16, with tensions simmering in the days leading up to it. When a demolition crew showed up March 9 ready to go to work, several days before the emergency permit had actually been issued, a neighbor who was trying to save the cottage phoned the police to halt the demolition. Police reports show that a few days later when the crew arrived on the property and were greeted by a small group of protesters, the cops were called twice more — by both sides. Joe Cassidy, Michael Cassidy’s brother and a prominent member of the Residential Builders Association, is the president of the demolition company.

Protesters charged that the building was neglected on purpose to hasten its demise, so the owners could skirt the regulatory EIR process. "It appears the property owner has exceeded the scope of their permit to replace dry rot by structurally damaging the building and claiming it is in imminent danger of falling down," Cynthia Servetnick, an architect with the SF Preservation Consortium, wrote in an e-mail to the City Attorney’s Office not long before the demolition. Building Commissioner Debra Walker, who also inspected it, noted that "the windows were out, and the doors were out in the back. It looked to me like people had just left it open."

Megan Allison Wade, who blogged about the demolition of the Lombard Street house, wrote in an e-mail to zoning administrator Larry Badiner that she perceived "a very clear case of willful neglect in an attempt to degrade the property into demolish-able condition."

Badiner responded: "This emergency demolition permit supersedes historic preservation and housing preservation procedures. … Without commenting on whether this is willful neglect, public safety would trump any concerns regarding how the building became unsafe."

An article published by the San Francisco Chronicle noted that Nunemacher denied that he and Cassidy had neglected the property. When we called Nunemacher to ask him directly, the conversation didn’t go so well. He said he was busy, and told us to read the other news reports. When asked if this meant he didn’t want to comment, he said, "You are putting words into my mouth. I don’t like what you are doing." Then he threatened to call the police.

Whether or not the property was in fact neglected on purpose is a question that may never be answered conclusively. City Attorney’s Office spokesperson Matt Dorsey told us he was not at liberty to say whether an investigation is underway, but it’s clear that any investigation would have to go forward without a crucial element — the house.

Attorney Arthur Levy made a last-ditch effort to try to save the Little House just before it came down, sending a letter transcribed on his office’s letterhead to a list of city department heads. "What makes San Francisco different is our built environment," Levy says. "It seems to me that when a property owner willfully neglects a building, and that results in demolition … there ought to be some consequences."

For some of those engaged in the fight over the cottage, the incident brings to mind past controversies involving the same players and others close to them. When an historic Victorian shipwrights’ cottage at 900 Innes Ave. — which the city designated as a historic landmark last year — was under the ownership of developer Joe Cassidy, he had plans to demolish it and build condos, retail space, and a kayak center. In that 2005 battle between the RBA developer and preservationists, the preservationists won.

Another project that involved both Joe Cassidy and Nunemacher was a residential development at Fourth and Freelon streets. At the time that project was being permitted, one of the top-selling agents at Vanguard Properties, Jean-Paul Samaha, worked as a liaison between the Board of Supervisors and the Planning Department. In 2005, architect Kepa Ashkenasy lodged an Ethics Commission complaint against Samaha alleging he had failed to disclose a $100,000 loan from Nunemacher, who had been his romantic partner at the time, even when he was in a position of testifying before the Planning Commission in his professional capacity about the Fourth and Freelon development, Ethics records show.

The complaint was dismissed after Samaha lodged a counter-complaint against Ashkenasy with the Human Rights Commission, noting that loans from spouses and domestic partners are exempt from financial disclosure rules, and charging that her allegation was motivated by a kind of homophobia, a HRC document shows. Ashkenasy told the Guardian that she only sought to illuminate a conflict of interest — and added that she is a lesbian.

Servetnick said the case of the Little House highlights a broader issue of vacant historic properties throughout the city that are allowed to go to waste because it’s more profitable to knock them down and build new. Draft legislation introduced by Board President David Chiu seeks to address this concern by requiring owners of vacant properties to register their empty buildings with the city so that inspectors can play a more proactive role in detecting problems before it’s too late.

At a March 26 Planning Commission meeting, Charles Marsteller, former head of government watchdog group Common Cause, told commissioners he had attended the demolition of the Lombard Street cottage. When it came down, he says, he realized how unique it was and earnestly told planning commissioners that he thinks the Little House should be reconstructed, and the lot turned into a park.

As for the demolition, "It was just a put-on by some insiders in City Hall working the network that they normally work," Marsteller says. "And it shouldn’t have happened."

Grand Theft Auto IV: The Lost and Damned

(Rockstar North; Xbox 360)

GAMER Ever since the "next-gen" consoles shipped with capacious hard-drives and easy access to the broadband interwebs, gamers have been paying the price. Picking up where the boxed expansion pack model left off, publishers realized they could nickel-and-dime their fans with "downloadable content packs," recalling the "Batmobile sold separately" chicanery of action figure advertising and failing to deliver even the most rudimentary bang for your buck.

It comes as something of a relief, then, when a developer eschews horse armor and warmed-over levels too crappy for the retail version and provides some downloadable content actually worth the bandwidth, let alone the greenbacks. Grand Theft Auto IV makers Rockstar North restore some hope with The Lost and Damned, a worthwhile 10-hour nugget of episodic expansion that once again turns gamers loose in the open-world cesspool of Liberty City.

You play Johnny Klebitz, a surly biker with bad tribal tattoos and a cadre of "brothers" in the Lost, one of the metropolis’ warring biker gangs. Engaged in a power struggle with the gang’s atavistic head honcho and mired in the world of crime that defines Rockstar’s dystopic settings, Klebitz is soon fighting for his life.

In keeping with the expansion’s hog-wild characters, Rockstar has retuned the motorcycle physics, making two wheels the optimum number for peeling around the vast gameplay environment. Your character has access to a handful of powerful new weapons, and your easy-riding cohort is a phone call away if you’re in need of manpower, horsepower, or firepower. New multiplayer modes cater to the bike-centric gameplay, including a new race mode in which competitors with baseball bats reenact Electronic Arts’ classic Road Rash series.

The writing and motion capture is consistent with the GTA series’ surpassing quality, and Rockstar again proves that careful characterization and plotting makes for a more engrossing gaming experience than a coterie of anonymous sidekicks yelling "boo-yah!" The events of The Lost and Damned intersect intriguingly with the original game, but this is both a blessing and a curse. Despite the developers’ best efforts, Johnny Klebitz isn’t half the protagonist GTA IV’s Niko Bellic is, and the moments when Bellic shows up are an unfortunate reminder of this fact. As with Bellic, the writers make an ill-conceived stab at humanizing their star criminal in Klebitz, presenting him as a voice of reason and moderation. But this all flies out the window once he’s mowing down cops in the dozens. Then again, when you’ve got a fully automatic shotgun to play with, who cares about psychological realism?

“After hours” lighting ban

Do you sometimes forget to flip the manual light switch when you leave the office? If so, Board President David Chiu hopes that the prospect of fines will help you break this environmentally unfriendly habit.

Chiu has introduced an ordinance that prohibits commercial buildings from lighting unoccupied interior spaces after business hours. The idea is to conserve electricity and use cost-effective lighting control technology that turn lights off automatically, when the last person leaves the office.

“Not only are lights typically left on in buildings when occupants leave an office during the middle of the day, but the night skylines of all U.S. cities are filled with lights from countless empty offices, and San Francisco is no exception,” states the “findings” section of Chiu’s ordinance, noting that almost half of the electricity in typical office buildings is used to keep lights on, and commercial establishments account for about half of the lighting energy used in the United States.

“No person may illuminate any unoccupied space in a commercial building after hours except for exit signs, path of travel lighting and utilization equipment lighting,” states Chiu’s ordinance.

If the ordinance passes, the Department of the Environment will be able to issue warnings to folks, a year after the ordinance becomes effective. If that doesn’t change folks’ behavior, DOE will be able to fine them $100 for a first violation, $200 for a second violation in the same year, and not more than $500 for each subsequent violation in the same year. Wow, that could add up. Pretty soon folks won’t be able to pay their electricity bill, which would be yet another way to turn the lights off.

A LAFCo “milestone” at today’s Board meeting

At meetings of the Local Agency Formation Commission, it’s all too common to hear concerns that the whole Community Choice Aggregation program endeavor is moving along at a snail pace. At today’s Board of Supervisors meeting, there will be vote on whether to approve two new LAFCo staff positions, which could jump start CCA. But is there enough support for eight votes, which would ensure that the decision could withstand a veto? And will Supervisor Sophie Maxwell, who voted against it at the last meeting but for it at a committee meeting the day before, stick with her ‘no’ vote?

LAFCo plays an advisory role in the implementation of San Francisco’s CCA program, which would allow the city to combine electricity needs of residents and businesses into a citywide electricity buyers’ program. Administered by the San Francisco Public Utilities Commission, the plan includes ambitious targets for clean and renewable-energy generation.

But the process of getting such a massive project off the ground has been fraught with delay, and it’s not uncommon for citizens to get up during the public comment session at LAFCo meetings to voice their anxiety that an environment threatened by climate change can’t afford to wait any longer.

Ladita: Sweet as an organic gluten-free cupcake

Quaintly nestled in San Francisco’s dreamy Bernal Heights district at 827 Cortland Avenue, Ladita is a darling little eco-boutique in that could be described as “similar to Anthropologie, but much better for the environment.” Even for someone whose overtly girly side is as repressed as mine, it will prove impossible to resist Ladita’s quiet charm. On my visit, scented (soy) candles bouqueted the store with the abstract but pleasant aroma of wildflowers, the soft, fuzzy sound of old folk LPs purred on the vintage record player and, in an almost suspiciously perfect touch, a lazy cat (the owner’s pet) napped under the cash register in a swath of warm afternoon sun. If a shopping experience could be distilled to a soothing cup of tea, this would be it.

There is no shortage of the lovely and the whimsical at Ladita, but Christine, the owner, is also a practical businesswoman, and her store is stocked with crowd-pleasing brands like James Jeans and Ella Moss, which complement more specific, eco-oriented labels like Stewart + Brown, Taxi CDC, and Sworn Virgins. Ladita offers a comprehensive and well-edited baby department, which includes Kicky Pants and Speecees, both favorites with eco-leaning moms and dads, as well as Erbaviva, a wonderful line of bath and body products for babies and moms-to-be.

Thanks so much for the great article on Climate Theater ("Still crazy after all these years," 2/25/09). I’ve lived and worked in SoMa since 1973 and can think of no art venue that has done more to create a vibrant, inspiring community.

If playa types like Suck Up Willie Brown (I’ve seen him at Hollywood parties) and our current mayor, The Talking Haircut, could live in Climate World for six months, they might develop souls.

THE FATE OF THE CHRON


Good riddance to the San Francisco Chronicle and good luck finding a buyer.

I know of one union that has already been cut to the bone — pressmen and prepress workers, Local 4N. As a matter of fact, there will be about 200 press workers out of a job in June when the Canadian Company Transcontinental starts printing the Chronicle at the new printing facility in Fremont. Not one member from the San Francisco Local has been hired.

All production department union jobs are being outsourced. This includes mailers, machinists, and electricians. I wouldn’t count on any of them giving anything up since they are going to be unemployed come June 29th.

Maybe the Hearst Corporation should cancel the 15-year, $1 billion contract it signed with Transcon. I’m sure all the unions that will be out on the street come June would be willing to sign contracts for a lot less.

Paging Matt Gonzalez! If truth is the first casualty of war, what is ceded in total occupation? Calvin Welch’s op-ed ("It’s a recession, let’s get cracking," 2/25/09) reflects the nascent realization that what San Francisco lost in electing Gavin Newsom over Gonzalez, the nation has now lost in validating the pro-corporate centrist DLC (Democratic Leadership Council) wing of the Democratic Party on a grand scale.

The opposition from the right is inarticulate and, as Welch notes, the truly democratic left is hopelessly inarticulate. Sustainability, of our environment, our economies, and our health is the challenge that must be met. It wasn’t that long ago that "a sleeping giant stirred in San Francisco." Can it happen again? Paging Matt Gonzalez!

GREEN CITY When we say a product is "eco-friendly," what we really mean is "eco-friendlier," as in "less ecologically damaging to the environment than available alternatives." The manufacturing process always has some negative effect on the environment, and while products may be labeled organic, biodegradable, recycled, acid free, ecospun, fair-trade, unbleached, vegetable-based, cruelty-free, or all-natural — they all require land, unclean energy, and unrenewable resources to produce.

The easiest way to start thinking eco-friendliest is to take into account the enormous amount of energy used in distribution. Sure, it’s unrealistic to expect all of our products to come from California, because certain things, like lifesaving medicine or Belgian ale, don’t have homegrown substitutes. But some items do have nearby equivalents. Here’s a guide to some of our favorite stylish eco-stops for locally manufactured gems.

REVIEW In the giant, rundown apartment buildings of Naples and Caserta, organized crime doesn’t run afoul of the law — it is the law. Based on the best seller of the same name by Roberto Saviano (who co-scripted), Matteo Garrone’s Gomorrah has already hauled in European laurels galore, including the Grand Prize at the 2008 Cannes Film Festival. Inexplicably not nominated for the Best Foreign Language Film Oscar (not uplifting enough? too violent?) or any Oscar for that matter (see: 2002’s City of God), this multicharacter drama examines the Camorra crime family from the ground up, zeroing in on personal stories to show how gangsters have their paws in everything from street-level drug dealing to toxic waste dumping to Italy’s famed haute couture biz. It’s a long movie, dense with characters and subplots, but standout moments shine above the desperation and grit: after an initiation ritual, baby-faced teenager Totò proudly rubs a gunshot-sized bruise on his chest, sustained through a bulletproof vest; cackling at the joy of finding a weapons cache, a pair of ne’er-do-well Scarface fans scamper in their skivvies; an educated young man realizes his lofty job is actually exploiting children, not to mention poisoning the environment. Filming in the Camorra’s actual stomping grounds, Garrone realistically replicates a world where everyone is in cahoots with the bad guys — whether they choose to be or not.

GREEN CITY If you’re thinking of greening your home, you might imagine that your that only option is to install expensive energy-efficient appliances — which many renters can’t do and many homeowners can’t afford. But don’t despair. There are ways to reduce your carbon footprint without significantly reducing your bank account, with or without a landlord’s help. Below are several tips from San Francisco’s premier green architect and eco-remodel guru Eric Corey Freed, principal at organicArchitect. His advice should make your home better for the environment and your utility bills.

Fridge Fundamentals The refrigerator is the single largest user of electricity in a household. Why make it work harder, pushing up your energy costs, by keeping it next to the oven? "Having a fridge and oven side by side is the stupidest thing I can think of that people do in kitchens," Freed laments. "An oven makes things hot, and a refrigerator is supposed to keep things cold — the two don’t belong together." Using the same rationale, it’s also a good idea to keep your fridge out of direct sunlight.

Also, if your fridge is more than a decade old, get over your attachment to the dated design and trade it in for a newer, energy efficient model. Pacific Gas and Electric Co. offers free pickups and a $35 rebate.

Think Thermal Heating your home is another major energy sucker. With more winter cold snaps on the way, investing one afternoon and less than $100 to heat smart will produce almost immediate results in lowering heating costs. The first place to look is your windows. While we love the light windows give, they are weak spots for heating. Freed suggests picking up a package of disposable window coverings ($20 for six windows). You may also be able to caulk around windows and vents to keep heat from escaping. Tubes cost less than $5 a pop.

Once you have your windows all snugged up, turn on the heat only when you need it. Freed recommends a programmable thermostat, which costs about $40. Once installed, you can set the heating to go down when you go to bed at night, kick on just before you get up in the morning, and shut off again when you leave for work. "It’s great, you just set it and forget it," Freed says. No more thumping your forehead at lunchtime realizing you left the heater cranking at home, using precious resources to warm empty rooms.

Shower Saver Most showers pour out 2.5 gallons of water per minute, but for $40 you can pick up an easy to install, water-conserving, lowflow showerhead that still gets you squeaky clean. Since many San Francisco buildings are old and hot water is slow to arrive, consider a model with a pause cord or stop switch. This holds the water in the pipes until it is warm and saves gallons of perfectly good water from being dumped down the drain while the heater warms up. Plus, renters can take the showerheads with them when they move to different digs.

Friendly Flushing Another way to conserve water — one that’s free and easy — is to add a full, two-liter water bottle to the toilet tank. This only takes a minute and eliminates a significant amount of water from being wasted every time you flush. Bottles are better than bricks, which also displace water but can damage your tank. If you’re feeling a little handier, grab a screwdriver and lower the float an inch or so. And if you’re feeling innovative, consider installing a toilet-top sink, which gives waste water a chance to be used more efficiently. This graywater system collects the tap water you use to wash your hands, then uses it to flush the toilet rather than sending it straight down the drain. (You’re washing with tap water, not toilet water, so there’s nothing dirty about it.) Sinkpositive.com sells toilet-top sinks for about $100. It’s also an appliance you can take from home to home.

Whither Indie?

What is indie now that Death Cab for Cutie, Animal Collective, the Shins, and TV on the Radio are part of the mainstream cultural conversation, making inroads on the Billboard charts and scoring award nods? Jordan Kurland — who heads the Noise Pop festival along with founder Kevin Arnold and, for that matter, manages Noise Pop vet Death Cab — definitely has pondered the question. "It would be interesting to do a chart on how many bands that played Noise Pop have won Grammys," he muses. Every year he and Arnold reassess whether to continue this clear labor of love ("We don’t make money," Kurland confesses. "We haven’t cracked that yet."), and this year, despite the tough economic environment with the number of shows contracting and the event’s music industry conference expanding, the two decided to hold steady. "We’re still here championing independent culture," Kurland affirms. After all, "now we’re so close to 20. And then once we get to 20, it’ll be, ‘But we’re so close to 25!’ We just really love it. The community still cares about it. And we’ll be inspired as long as people show up for shows and keep talking about it."
