Avalos initiates LOCAL SF

Sups. John Avalos, Sophie Maxwell, David Campos and Board President David Chiu, plus community advocates, construction contractors, neighborhood leaders and union members rallied outside City Hall today to announce the launch of LOCAL SF, a campaign for local opportunities and hiring for San Francisco residents. 

And this afternoon, Avalos introduces the first measure of this campaign–legislation mandating local hiring on publicly funded construction projects.

Avalos’ local hiring legislation is a major departure from the city’s current First Source Program. In place for the past decade,First Source only requires contractors on publicly subsidized projects to show “good faith” efforts to meet a local hiring goal of 50 percent. 

By contrast, Avalos’ proposed legislation will require contractors to meet local hiring goals that will be phased in over the next few years.

“My legislation will ensure that San Franciscans have a guaranteed shot to work on the City’s public works projects and that the local dollars invested in public infrastructure be recycled back into San Francisco’s economy and local communities,” Avalos said in a press release,

Avalos’ introduction of this mandated local hiring legislation comes on the heels of a report from the the Mayor’s Office of Economic and Workforce Development that shows only a 20 percent local hire rate in 29 publicly-funded projects, despite the 50 percent local hiring goal and good faith efforts of the city’s First Source program.

Avalos says his local hiring legislation was developed over a series of stakeholders meetings with representatives from city agencies, the Mayor’s Office, labor and building trades, the environmental community, neighborhood advocates, contractors, local hiring advocates and unemployed workers, And he vows to keep this roundtable approach going, as his legislation moves forward.

“Over the next few weeks, I intend to keep a dialogue going with all of these stakeholders to strengthen the legislation as it moves through the legislative process,” Avalos said.
  
His legislation is scheduled to be heard in the Board’s Land Use and EconomicDevelopment Committee in November. And it comes not a moment too soon: with unemployment rates remaining high and major construction projects in the pipeline, it’s critical that city leaders ensure that any related work really benefits the local community.

With five supervisorial seats open and only one incumbent running, the Labor Council has had a tough time picking the right pro-labor candidates. The easy choices were incumbent Carmen Chu in District 4, with no opposition, and Raphael Mandelman, an exceptionally promising newcomer in District 8. But Janet Reilly in District 2 opposes the Labor Council’s revenue measures. In District 6, where long-time activist Deborah Walker has been endorsed, and in District 8, where Malia Cohen and Chris Jackson are #1 and #2, there are a multitude of candidates, many of them labor friendly.

It’s not an easy year.

Prop. B on San Francisco’s November election ballot confronts the city’s working people and their unions with an unprecedented challenge. The measure, sponsored by Public Defender Jeff Adachi, would severely weaken public employee unions and undoubtedly lead to other serious attacks on workers and unions in private as well as public employment nationwide.

The proposition is by no means the only dangerously anti-labor measure on the ballot, but it ‘s the worst from labor’s point of view, as it very well should be. It’s a prime example of the public-employee bashing that’s become a favorite theme in election campaigns everywhere and, if passed, would set a clear national precedent.

Actually, Prop. B might better be described as a pummeling rather than bashing – and one coming, furthermore, just a few months after city employees took a voluntary $250 million pay cut. Prop. B would steeply raise the employees’ contributions to their pensions unilaterally and prohibit bargaining on the issue in the future as well.

It would arbitrarily lower city contributions to the employees’ health plans, especially dependent care. What employees pay for health care coverage for children and other dependents would be as much as doubled.

The steep rise in the employees’ share of their health care coverage could quite possibly force families to drop city coverage and try to get cheaper coverage on their own. That, of course, is a primary goal of the corporate anti-labor forces and others who seek to balance the budgets of public entities on the backs of their employees.

So what if workers can’t afford to take the kids to the doctor.  Cutting taxes and balancing budgets is a lot more important. Besides, there’s always the emergency room and charity.

But wait! There are yet more major Prop. B flaws. For example: If city health care coverage is changed by increasing the premiums paid by employees, as the proposition requires, the city Health Service system (HSS) would have to forfeit new $23 million-a-year federal grants intended to reduce premiums for employees and retirees covered by the HSS. The system includes, not just city employees, but also school and community college district and SF court system employees and retirees.

There’s even more, much more than enough to energize labor’s troops. They are angry. Very angry. Unions citywide have at least temporarily set aside their sometimes considerable differences and feuding over tactics, jurisdictions and other matters. They’ve come together tightly along with a substantial number of labor’s Democratic Party allies to oppose Prop. B.

And watch out for Prop. G. It’s another favorite of the anti-union, anti-public employee crowd, led in this case by Sean Elsbernd, a very politically ambitious member of the SF Board of Supervisors.

Elsbernd and friends claim their intent is to “fix the Muni,” one of the nation’s most complex transit systems. The Municipal Railway, overseen by the Metropolitan Transit Authority (MTA), is indeed badly in need of fixing. But the principal blame for that does not rest with Muni’s bus and streetcar operators – most of them people of color – as proponents of Prop. G claim. Most of the blame rests with Muni’s overpaid managers, headed by $336,000-a-year executive director and CEO Nathaniel Ford.

As President Irwin Lum of the Muni operator’s union said in a Guardian interview,  “Muni needs to be changed from the top to the bottom.” He sees Muni’s problem as mainly a lack of resources and the political will to pursue them.  Muni officials might also avoid lots of problems if they’d deign to consult regularly with community groups and their leaders on their transit needs.

The public rightly complains of buses not arriving on time, of being passed up while waiting at bus stops, of grumpy drivers and of other certainly legitimate matters.  Naturally, they blame the drivers. But drivers do not make schedules. Under pressure to keep to the schedules made by others, they sometimes speed by waiting passengers. Sometimes they’re slowed by heavy traffic, sometimes by problems with faulty, broken-down down buses or slowed by having to deal with violent passengers. Sometimes, managers making out the schedules don’t properly anticipate such probable delays.

Oh, yes, those grumpy drivers.

Wouldn’t you be grumpy if you had to work a full shift without going to the bathroom? If you had to listen to loud complaints from unruly passengers who sometimes got rough with you and each other?  If you had to weave through heavy traffic for hours at a time? If you had to time your work to unrealistic schedules you had nothing to do with making?

It’s not the drivers who are in charge of replacing badly worn buses and streetcar tracks and equipment, not the drivers who are in charge of negotiating with Muni suppliers for a reduction in ever-escalating fuel prices and other costs. In short, it’s not the drivers who run Muni – though Muni, of course, could not run without them.

So, what do Elsbernd and his anti-labor cohorts want to do to the Muni’s invaluable workers? Here’s the deal:

The City Charter now requires that Muni operators be paid at least as much as the average salary of operators at the two highest paying similar transit systems in the country.  And if benefits granted Muni operators are worth less than those of operators at similar transit systems, the difference is paid to the operators from a trust fund established for that purpose.

Under Prop. G, operators’ pay and benefits would be set by bargaining between union and MTA representatives. If they couldn’t agree, the dispute would be submitted to an arbitrator, whose decision would be binding.

The arbitrator would be required to consider the possible impact of disputed proposals on Muni fares and services. But though all other city unions are also subject to arbitration, there’s no requirement that the arbitrator consider how their proposals would affect the services provided by the union’s members – an unusual requirement that’s virtually unheard of elsewhere.

Prop. G backers presumably see the proposition as a step toward their goal of being able to set, change or eliminate Muni work rules without bothering to consult workers or their unions. They are, you might say, “unilateralists.”

 Taking on Muni operators is only part of Supervisor Elsbernd’s anti-labor romp. He’s also sponsoring Prop.  F, a deceptively simple charter amendment that would seriously impact the 105,000 members of the Health Service System. It’s a stealth proposition, difficult to understand and explain, and thus often brushed aside as a minor ballot measure of no particular consequence.

But Prop. F is capable of doing major long-term damage to HSS members by weakening their position in negotiating with powerful health insurers such as Blue Shield on the size of the premiums HSS members have to pay for coverage and the benefits they receive.

All politicians stretch the truth. It’s part of their game. You needn’t look further than Elsbernd for evidence of that.  He actually claims he put Prop. F on the ballot strictly to save the Health Service System money by eliminating two of the four elections in which HSS members vote for representatives on the HSS Board. This seemingly small change would eliminate the overlapping terms that provide the continuity essential to successful negotiations with health insurers.

The savings would average a mere $30,000 a year, and would not even be available until 2016. Nor is there a guarantee that any of the money would go to the HSS. $30,000? What’s the real motive here?

As for the rest of San Francisco’s ballot measures and candidates, union supporters could hardly do better than to follow the recommendations of the AFL-CIO’s local Labor Council, which almost invariably backs the propositions most likely to be labor-friendly and opposes those that are not. This time, the Labor Council is saying “no” to those decidedly unfriendly Propositions B, G and F.

And don’t forget Props. J, K and N. Hotel workers and others are supporting Prop. J, which is meant to stop the travel industry practice of using online hotel booking to avoid paying SF’s hotel tax. Prop. J also would increase the city’s hotel tax for the first time in 14 years in order to raise some most welcome revenue for the city’s general fund.

However, Prop. K – introduced by Mayor Newsom – could stand in the way. Since Prop. K makes no change in the hotel tax rate, apparently it’s intended to confuse and distract the voters so they won’t approve Prop. J.

The other major revenue measure strongly supported by labor – Proposition N – would increase the city’s transfer tax rate on the sale of property worth more than $5 million from 1.5 percent now to a range of 2 to 2 ½ percent for a property worth $10 million or more. This would also generate millions for the city’s general fund.

Rarely has so much been at stake for San Francisco’s working people and their unions.

Lending art in the TL

Throughout the course of writing my feature story about the Tenderloin this week, which looks at the role art is playing in the gradually changing neighborhood, a couple of questions kept cycling back into the forefront of my mind. What should be the role of art in community-building? What kinds of art benefit the residents of a neighborhood? It’s tough to categorically define the answers, but Rick Darnell and the North of Market Community Benefit District‘s plans for a TL art lending library come damn close to a perfect score.

The Tenderloin Art Lending Library (TALL)’s planned role in the community is double-fold: one, it will provide a boost to “outsider” artists in the Tenderloin, people who have never had their art displayed in a studio and may lack the career know how to make that happen, and two, their pieces wind up in the homes of people who otherwise would have few touches of beauty there — at least not original works by creative minds. “A lot of artists never get discovered,” Darnell tells me, sitting in the basement room that the NOM-CBD has allocated to housing the library. Donated paintings lean against the walls around us, and a table is stacked with interesting metal sculptures behind my chair. 

His goal is to get this art into the homes of the Tenderloin’s recently housed residents. The neighborhood is well known as a drop-off spot for released convicts, Darnell tells me, and has a high percentae of residents on parole and probation. Between the recently incarcerated and the participants of the City’s “Care Not Cash” transitional housing program, you have a lot of people who need help making their new rooms homey.

Every three months TALL participants will be allowed to take a different piece of art for their space. Not everyone’s used to having nice things though. Darnell anticipates the challenges that this will entail, and tells me that those hurdles are kind of the point.

“It’s based on trust and sharing and a celebration of those two things,” he says. He’s got a system worked out for participants that mess up their given canvass or sculpture: six months probation from the library if they sold it or destroyed it, but leniency if the damage was due to carelessness or misfortune. “If it’s something like the dog eats it, we’ll work with them to find another place in their house that would be better for the painting,” he says, adding that program volunteers will be prepared to make house visits to make this happen, or to involve less mobile residents. “We want to make this a good experience for them.”

Some of the pieces around us, Darnell tells me, were done by artists afraid to leave their own house, elderly artists, recovering addicts, current addicts. Many artists have volunteered their art – he shows me one small canvass covered in dynamic swooshes of primary colors that came from an artist in Colombia that saw his call for admissions online – but he gives priority to Tenderloin artists, who seem to be the ones that are most connected to the mission anyway. “The people who have the least to give, I’ve found, are the most generous,” he says.

Darnell knows what helps people get better: in addition to his years spent working with society’s forgotten communities, he’s been a part of them himself. “I’ve dealt with addiction, I’ve dealt with being homeless,” he tells me straight-forwardly. 

He’s got no issue with recounting his story. An MFA recipient in dance and design from the integrative learning-based Bennington College, he traveled the country after graduation dancing with a troupe that performed in non-traditional venues and focused on social issues in their productions. 

But he fell into drug use, and in1989 tested positive for HIV. He moved directly into the Tenderloin when he got to San Francisco and hasn’t left since, finding the expansive gay community “astounding.” He’s been clean for years, and seems inordinately enthused for a guy that’s been through a lot. “I’m just really happy to be here and doing this.”

Perhaps it was a no-brainer that someday Darnell connect his love of helping others in a tight spot with his love of art, given the role that it plays in his own mental clarity. “I draw something everyday,” he says. “I’ve drawn thousands of bullets, thousands of popper bottles. The shapes are really calming to me.” 

Until recently a long time employee of the Hospitality House, a resource center for homeless individuals around the corner from the NOM CBD that includes a drop-in arts studio, employment help, and a men’s shelter, Darnell was hired at the Community Benefit District initially as a janitor. But the organization invested $15,000 in seed money so that he could flesh out his vision of a community enhancing arts program. Now he’s in charge of outreach and general operations of the project. 

“It seems frivolous, like maybe I should be doing a food drive – but these are all sides of a well rounded person,” he reflects. Darnell initially considered starting a tool lending library, but changed his mind when he considered that the art exchange would give TL artists a chance to work on their craft, as well as gain some valuable artistic experience – pieces will be displayed in the gallery that gracefully inhabits the current lobby and front hallway of the NOM CBD.

He envisions the library as a place where people can come and connect using the language of art. “You might come to have a salon community,” he suggests regarding residents’ use of the future space. It’ll be open Fridays and Saturdays from 12-3 p.m., starting with a kick-off party on Oct. 30. 

We chat briefly about some of the other recent arts development in the neighborhood. I first met Darnell at a fairly informal meeting of TL art types convened by the Tenderloin Economic Development Project’s Elvin Padilla. In addition to the Darnell’s presentation of his library, a representative of a well known theater discussed plans for expansion, possibly in the Tenderloin. Another performing arts organization announced they were looking for a TL address, and various art galleries discussed openings and future collaborations with each other. 

“A lot of people put endeavors in the Tenderloin because rent is cheap, and it’s slowly changing the area,” Darnell tells me of people he refers to as “carpet baggers.” We talk about a comment he overheard from a gallery owner in the area after Rick announced his plans for the lending library to the group. The individual had muttered “I’d never lend anything to anyone in the Tenderloin.” “For good reason,” Rick continues “people are wary of homeless folk.”

But Darnell doesn’t seem to be wary of the recently homeless folk he’s passing out TALL fliers to and still collecting donations of art for. In fact, he seems stoked on his continuing role in their lives, and stoked for the day the library’s circulation begins at the end of next month, when they’ll eat light snacks and start making connections through art. 

“If there’s anyplace that’s open to this stuff,” he tell me “it’s the Tenderloin.”

This is a story about love and money. Or a story about love, money, and location. — Rebecca Solnit, Hollow City (Verso 2000)

It’s a sunny day in the most maligned neighborhood in San Francisco. I’m walking down a busy sidewalk with an excited Randy Shaw, long-time housing advocate. He’s giving me a tour of his Tenderloin.

“There’s history everywhere you look here,” he notes as we rush about the dingy blocks of one of the city’s most densely populated, economically bereft communities. In a half-untucked navy button-down and square-frame glasses, Shaw reels off evidence of this legacy faster than I can write it down and still maintain our walking pace.

To our left, Hyde Street Studios, where the Grateful Dead recorded its 1970 album American Beauty. Across the street, a ramshackle building that once housed Guido Caccienti’s Black Hawk nightclub, where the sounds of jam-fests by the likes of Billie Holiday and John Coltrane would echo out onto the streets during its heyday in the 1950s. Throughout its history, the Tenderloin has been renowned for its nightlife: music, theater, sex work — and the social space that occurs between them.

Shaw came to the Tenderloin 30 years ago as a young law student and founded and built the Tenderloin Housing Clinic, a nonprofit agency that is now one of the largest property owners in the neighborhood and employs more than 250 full-time workers. Shaw has spent the last few decades fighting to improve conditions in the single-room occupancy hotels, or SROs, once notorious for malfunctioning heating systems and mail rooms that would dump the letters for their hundreds of low-income residents into a pile on the floor rather than fit them into personal lock boxes (which now line the walls of THC’s lobbies).

But that activism isn’t the reason for this tour. No, today Shaw is showing me why tourism can work in the Tenderloin. The heavy iron gate of an SRO is quickly buzzed open as the doorman recognizes him. Inside, working-class seniors mill about aided by walkers — this particular property is an old folks’ home — but over our heads, affixed to a majestically high ceiling, looms a triple-tiered glass and metal chandelier, evidence of the area’s architecturally important past.

“When I show people this,” Shaw smiles at my amazement at this bling in a nonprofit apartment building, “they’re amazed at the quality of the housing.” Further down the road, we peep in at a vividly Moorish geometric vaulted ceiling and a lobby that once housed a boxing gym where Miles Davis and Muhammad Ali liked to spar. Both are now home to the inner city’s poorest residents.

Of course, it’s not just tours that we’re talking when it comes to Shaw’s plans for the future. Shaw has acquired a 6,400-square-foot storefront in the Cadillac Hotel on the corner of Eddy and Leavenworth streets, where he plans to open the Uptown Tenderloin Museum in 2012. He says it will showcase the hood’s historical legacy as well as house a nighttime music venue in the basement. The increased foot traffic, he says, will do good things for public safety (a problem that has been identified as a high priority by the resident-run Tenderloin Neighborhood Association) and bring business to the neighborhood’s impressive collection of small ethnic restaurants.

An increased focus on the Tenderloin’s heritage and public image, Shaw says, will translate to more jobs and a better quality of life for the people who live here. “My goal is to have this be the first area in an American city where low income people have a high quality of life,” he says.

If Shaw is correct, it will indeed be a first. Many cities have attempted to transform low income areas with arts districts — and the end result has typically been the displacement of the poorer residents. Coalition on Homelessness director Jennifer Friedenbach described the process: “Gentrification follows a very specific path. First come police sweeps, then the arts, then the displacement. That’s the path that we’re seeing. Hopefully we’ll be able to avoid the displacement part,” she says.

It’d be great if the Tenderloin took the road less traveled — but will it?

Shaw’s best-case scenario seems unlikely, according to Chester Hartman, a renowned urban planning scholar and author of the numerous studies of San Francisco history and the activist handbook Displacement: How to Fight It (National Housing Law Project 1982). Hartman doubts the Tenderloin will remain a housing option for the city’s poor, given its central location and market trends. “The question is, what proportion will move and what will stay?” he said in a phone interview.

Earlier this summer, the National Endowment of the Arts awarded the SF Arts Commission $250,000 toward an arts-based “revitalization of the mid-Market neighborhood.” The area, which is adjacent to the Tenderloin, is considered by many to be the more outwardly visible face of the TL. In truth, the two neighborhoods share many of the same issues and public characteristics, including high density living and prominent issues with drugs.

Amy Cohen, Mayor Gavin Newsom’s director of neighborhood business development, said the Newsom administration is using the money “to implement arts programming that would have an immediate impact on the street. These activities would then build momentum for the longer-term projects.” At this point, plans for that “immediate impact” have started with the installation of lights on Market Street between Sixth and Eighth streets. Two other projects are also in effect: a city-sponsored weekly arts market on United Nations Plaza and an al fresco public concert series.

It’s hard to distinguish these moves from a general trend toward rebranding the image of the Tenderloin. These streets have already seen Newsom announce a historic preservation initiative that put $15,000 worth of commemorative plaques on buildings; it was also announced they would be added to the National Register of Historic Places, a move that allows property owners deep tax cuts for building renovations.

Cohen said her office has spent time trying to attract a supermarket (something the neighborhood, although flush with corner stores, currently lacks), but efforts seem to be faltering. “Grocery store operators and other retailers perceive that the area is unsafe and have expressed concerns about the safety of their employees and customers,” Cohen said. “The arts strategy makes sense because it builds on the assets that are there. Cultivating the performing and visual arts uses that are already succeeding will ultimately enhance the neighborhood’s ability to attract restaurants, retail, and needed services like grocery stores.”

These days, many of the small businesses in the area have window signs hyping “Uptown Tenderloin: Walk, Dine, Enjoy” over graphics of jazzy, people-free high-rises. Looking skyward, one observes the recent deployment of tidy street banners funded by the North of Market/Tenderloin Community Benefit District that pay homage to the number of untouched historic buildings in the neighborhood. The banners read “409 historic buildings in 33 blocks. Yeah, we’re proud.”

Figuring out who benefits from these new bells and whistles can seem baffling at times. Even the museum plan, which Shaw says will draw inspiration in part from New York’s Tenement Museum, has drawn criticism. A July San Francisco Magazine blog post was subtitled “An indecent proposal that puzzled even the San Francisco Visitors Bureau” and likened Shaw’s attempts to the “reality tourism movement” that takes travelers through gang zones in L.A. and poverty-stricken townships in South Africa.

This seems to be a misconstruction of what he’s attempting. “You know what no one ever calls out? The Mission mural tours, the Chinatown tours,” Shaw says.

And Shaw scoffs when I bring up that PR bane of the urban renewer: gentrification. He takes me through a brief rundown of the strict zoning laws in the Tenderloin, adding that many people don’t believe that poor people have the right to live in a high-quality neighborhood: “I haven’t been down here for 30 years to create a neighborhood no one wants to live in.”

Indeed, thanks to the efforts of Shaw and others, it would be hard for even the most determined developers to get rid of the SRO housing in the Tenderloin.

In the 1980s, community activists struggled to change the zoning designation of the neighborhood, which lacked even a name on many city maps. The area was zoned for high-rise buildings and was being encroached on by the more expensive building projects of tourist-filled Union Square, Civic Center, and the wealthier Nob Hill neighborhood. Their success came in the form of 1990s Residential Hotel Anti-Conversion Ordinance, which placed strict limits on landlords flipping their SROs into more expensive housing.

Hartman remains unconvinced of the efficacy of the protective measures activists have won in years past; indeed, even SRO rental prices have soared. According to the Central City SRO Collaborative, in the decade after the Anti-Conversion Ordinance, rental prices increased by 150 percent, not only pricing residents out of the Tenderloin but out of the city. “Where do they move?” Hartman asked. “It’s probably the last bastion of low-income housing in the city. That changes the class composition of the city.”

“The neighborhood has been changing slowly but steadily,” says District Six Sup. Chris Daly when reached by e-mail for comment on the Tenderloin’s future. He writes that rents in the neighborhood have been consistently rising and that several condo development proposals have crossed his desk. Daly has been involved in negotiating “community benefits” and quotas for low income housing in past mid-Market housing projects, but has been disappointed by subsequent affordable housing levels in projects like Trinity Plaza on the corner of Sixth and Market streets. In terms of the Tenderloin, he said, “it is untrue to say that the neighborhood is immune from gentrifying forces. It is shielded, but not immune.”

But some see the influx of art-based attention to the area as a possible boon to residents. Debra Walker, a San Franciscan artist who is running for the District 6 supervisor post, said she believes arts can be used “organically to resolve some of the chronic problems in the Tenderloin, street safety being the primary one in my mind.”

Though most of her fellow candidates expressed similar views when contacted for this story, western SoMa neighborhood activist Jim Meko said he thinks artists in the area are being used to line the pockets of the real estate industry. “The idea of creating an arts district is an amenity that the real estate dealers want to see because it makes the neighborhood less scary for their upper class audience” he says.

The area clearly has a rich legacy of nightlife, arts, and theater. The Warfield is here, as is American Conservatory Theater, the Orpheum, and the Golden Gate. So is the unofficial center of SF’s “off-off Broadway district,” which includes Cutting Ball Theater and Exit Theater. The Exit has been located in the TL since its first performance in 1983, held in the lobby of the Cadillac Hotel, and sponsors the neighborhood’s yearly Fringe Festival. There are art galleries and soup kitchens, youth and age, and more shouted greetings on the streets than you’ll hear anywhere else in the city.

No one is more aware of this diversity of character than Machiko Saito, program director of Roaddawgz, a TL creative drop-in center and resource referral service for homeless youth. I met Saito in the Roaddawgz studio, which occupies a basement below Hospitality House, a homeless community center that also houses a drop-in self-help center, an employment program, men’s shelter and art studio for adults in transition.

Despite its being empty in the morning before the open hours that bring waves of youth to its stacks of paints and silk-screens, Roaddawgz is in a glorious state of bohemian dishevelment that implies a well-loved space. It could be a messy group studio if not for the load-bearing post in the center of the room covered with flyers for homelessness resource centers and a “missing” poster signed “your Mom loves you.”

We talk about how important it is that the kids Saito works with have a place like this, a spot where they can create “when all you want to do is your art and if you can’t you’ll die.” A career artist herself, she cuts a dramatic figure in black, safety pins, and deep red lipstick painted into a striking cupid’s bow. Her long fingernails tap the cluttered desk in front of her as she tells me stories from the high-risk lives that Roaddawgz youth come to escape: eviction, cop harassment, theft, rape.

The conversation moves to some of the recent developments in the area. Saito and I recently attended an arts advisory meeting convened by the Tenderloin Economic Development Corporation’s executive director, Elvin Padilla, who has received praise from many of the TL types I spoke with regarding his efforts to connect different factions of the community. Attendees ranged from a polished representative from ACT, which is considering building another theater, for students, in a space on Market and Mason streets, to heralded neighborhood newbies Grey Area Foundation, to Saito and longtime community art hub Luggage Store’s cofounder Darryl Smith. Talk centered on sweeping projects that could develop a more cohesive “identity” for the neighborhood.

I ask Saito how it felt for her to be involved with a group whose vision of the neighborhood might be focused on slightly different happenings than what she lives through Roaddawgz. She says she’s been to gatherings in the past where negative things about the Tenderloin were highlighted. Of Padilla’s arts advisory meeting, she says, “I think that one of the reasons I wanted to go was that it’s important [for attendees] to remember that there’s a community out there. Things can get really complicated. It’s hard to come up with decisions that affect everyone positively. If we’re going to say, ‘The homeless are bad; the drug addicts are bad; the business owners that don’t beautify their storefronts…” She trails off for a moment. “I don’t want to lose the heart of the Tenderloin.”

In yet another Tenderloin basement — this one housing the North of Market-Tenderloin CBD, an organization that is known for its work employing ex-addicts and adults in transition — Rick Darnell has created the Tenderloin Art Lending Library. The library accepts donated works from painters and makes them available for use by Tenderloin residents, many of whom have recently moved into their SRO housing and are in need of a homey touch.

Darnell is rightfully ecstatic at the inclusive nature of his library, but has been hurt over its reception at an arts advisory meeting he attended to publicize its creation. “Someone whispered under their breath ‘I would never lend anything to anyone in the Tenderloin,’ ” he tells me. The exclusion that Saito and Darnell sometimes feel highlights the reality that the definition of the Tenderloin might well vary, even among those who are set on making it “a better place.” The arts community appears to suffer from fractures that appear along the lines of where people live, their organizational affiliation, their housing status, and how they think art should play a role in community building.

Sammy Soun is one Tenderloin resident who would welcome an increased focus on art in the Tenderloin. Soun was born in a Thailand refugee camp to Cambodian parents fleeing the civil wars in their country. He grew up in the Tenderloin, where his family lived packed into small studios and apartments.

But he was part of a community, with plenty of support, and lives in the neighborhood to this day, as do one of his four siblings and his daughter. Soun paints, does graffiti, draws — he’s considering transferring from City College to the San Francisco Art Institute. He has worked at the Tenderloin Boys and Girls Club for nine years, giving back to the kids he says “are the future. They’re going to be the ones that promote this place or keep it going — if they want to.” His sister, cousins, and uncles still live in the neighborhood. You might say he has a vested interest in the area’s future.

He finds the incoming resources for the Tenderloin arts scene to be a mixed bag. Soun has never been to the Luggage Store, although it’s one of the longtime community art hubs in the area. He can’t relate to the kinds of art done at the neighborhood’s recent digital arts center, Grey Area Foundation for the Arts, though he says the space has contacted him and friends to visit. His disconnect from the arts scene implies that future arts projects need to work harder on their community outreach — or even better, planning — with artists who call the Tenderloin home.

But Soun loves the new Mona Caron mural the CBD sponsored on the corner of Jones Street and Golden Gate Avenue. Well-known for her panoramic bike path mural behind the Church Street Safeway, Caron painted “Windows into the Tenderloin” after dozens of interviews and tours of the neighborhood with community members. Its “before and after” panels are a dummies’ guide for anyone seeking input on ways to strengthen the Tenderloin community — though the “after” does show structural changes like roads converted into greenways and roof gardens sending tendrils down the sides of buildings, the focal point is the visibility of families. Where children were ushered through empty parking lots single-file in the “before” section, the second panel shows families strolling, children running, a space that belongs to them.

Our interview is probably the first time somebody has asked Soun where he thinks arts funding in the Tenderloin should go. “For projects by the kids in the community,he said.

Truth be told, more art of any kind can only make the Tenderloin a better place — but if you’re trying to improve quality life, focus needs to be on plans that positively affect residents of all ages — art can be a vital part of that, but it should be one part of a plan that ensures rent control, safe conditions, and access to services. After all, if you’re going to rebrand the Tenderloin, you might want to look at the painting on the wall.

It’s no secret that San Francisco is a particularly costly place to live. It consistently ranks in the top 10 most expensive cities nationwide, and it isn’t uncommon to see people renting out their walk-in closets as makeshift bedrooms to make ends meet.

There’s ample evidence that the city’s market-rate housing is out of reach for many families, middle-class workers, and low-income populations, particularly during the recession. Yet the shortage of affordable housing is a problem that is going largely unaddressed at City Hall.

The city’s General Plan estimates that a full 61 percent of new housing would have to be affordable to satisfy the housing needs of city residents, but even the most demanding development standards fall far short, producing only about half that amount. And while most new affordable housing is built for low-income people, a sizable portion is intended for first-time homebuyers with salaries at the highest threshold of affordability. In recent years, about one-third of new “affordable housing” was built to sell to people with “moderate” incomes.

So as big plans are mapped out for new residential developments composed of mostly market-rate units, what’s the strategy for addressing the underlying affordability gap? And will it ever be enough to keep from further turning San Francisco into a city of rich people while its workers are forced to live elsewhere?

This map, which appears in San Francisco’s Five-Year Consolidated Plan, charts concentrations of low- and moderate-income households in the city using HUD 2000 income data. Under federal guidelines, people with low and moderate income could be eligible for affordable housing.

A San Francisco Unified School District proposal to create new housing for San Francisco teachers underscores just how mismatched housing prices are to income. The National Low Income Housing Coalition (NLIHC) estimates that San Francisco renters paying market rate in 2010 would have to earn $56,240 to afford rent a one-bedroom apartment, $70,400 for a two-bedroom unit, and $94,000 for a three-bedroom unit, assuming they spend no more than about one-third of their income on housing.

A starting teacher’s salary in San Francisco is $50,000, so early-career educators may feel the squeeze. A survey of teachers conducted for the proposal found that 81 percent of respondents were renters, most living with unrelated roommates. More than half had plans to relocate in five years to a city where they could afford to be homeowners.

Housing was a hot-button issue at the Sept. 16 Planning Commission hearing on the environmental impact review for a hospital and housing complex that California Pacific Medical Center wants to build near Van Ness Avenue.

“The CPMC EIR fails miserably to analyze the income of the CPMC work force, and where it’s supposed to be housed,” affordable housing advocate Calvin Welch told the Guardian. “It’s a profoundly important question. If they are [providing] jobs that produce incomes that are insufficient to pay for average market-rate housing in San Francisco, who’s responsibility is it going to be to build housing for that workforce?”

 

WHO CAN AFFORD IT?

San Francisco has a reputation as a diverse, politically engaged hub that supports emerging artists, independent thinkers, and advocates for youth, workers’ rights, healthy ecosystems, protections for the most vulnerable segments of society, and hundreds of other causes. Without economic diversity — which is only possible when housing is available to people with a range of incomes — it might be a different place.

NLIHC estimates that 65 percent of San Francisco households are renters, and a significant number are what the Mayor’s Office of Housing (MOH) calls “cost-burdened,” shelling out more than a third of their incomes on rent. To get by, tenants have been known to cram roommates in like sardines, or cling tenaciously to a rent-controlled unit.

In a thick report outlining affordable housing goals for 2010–14, MOH and two other city agencies clearly articulate the housing challenges facing low-income renters. For one thing, the report says rents are going up despite the economic recession and declining home prices. And most people’s salaries don’t stretch far enough to cover those high prices. Even though there are 16 billionaires and some fabulously wealthy CEOs residing in San Francisco, the majority of people work in more mundane occupations like waiting tables, retail, office work, nonprofit jobs, teaching, health care, or public service.

The MOH report notes that despite the city’s relatively high median income, there’s a widening gap between top earners and people on the lower end of the spectrum, so few households actually wind up in that middle zone. “In fact, over a quarter of San Francisco’s population earns under 50 percent of [area median income],” the report states. For individuals in 2010, this translates to one in four people earning $34,800 or less. Compounding that problem are recent unemployment figures indicating that nearly one in 10 is jobless.

About one half of San Francisco’s population is considered low- or moderate-income, the housing report notes, using the standards used to formulate affordable housing prices. MOH uses a tiered income matrix, calculated using federal guidelines, to determine who could qualify for housing below the market rate. If you make $20,900 or less, you’re counted as “extremely low income.” You’re “very low income” if you make between $21,000 and $34,800, “low income” if you earn between $35,496 and $55,700, and if you make between $56,376 and $83,500, you count as “moderate income.” Even these figures are skewed higher because they include data from wealthy Marin County. As a point of comparison, U.S. Census data estimates that the median income for American workers was $29,530 over the last several years.

Most of the new affordable housing constructed in San Francisco is aimed toward people in the lowest ranges, but in recent years one-third was built for those with moderate incomes, which could gentrify some parts of the city. “Supervisorial Districts 3, 6 and 10 had rates of more than 40 percent extremely low and low-income,” the MOH report notes. “These three districts make up the entire eastern part of the city.”

A Guardian analysis of Bureau of Labor Statistics occupational and wage estimates for 2009 suggests that about 71 percent of people who work in San Francisco (many commute from less expensive places) earned less than that highest “moderate” salary limit of $83,500. It suggests that the vast majority of the workforce could not afford market-rate housing unless they sought it in pairs or groups.

“A big issue is the inability of San Francisco’s employment market to produce jobs that pay people enough to afford housing,” Welch says. “There’s a mismatch between market-rate income and market-rate housing costs. We’re housing somebody else’s workforce.”

Another stab at assessing the affordable housing need gazes into the future. The Housing Element of the San Francisco General Plan includes an estimate for the city’s future housing needs for the better part of the decade. The city should build 31,200 new housing units to meet its need, the General Plan says, and “at least 39 percent of these new units must be affordable to very low and low-income households. Another 22 percent should be affordable to households with moderate incomes.”

What this adds up to is a full 61 percent of new residential development in San Francisco ought to be dedicated to some form of affordable housing. The calculation reveals a lot about the condition San Francisco is in, but it might as well be chalked up as a hollow academic exercise. Indeed, the report deems this goal “unrealistic.” The reality of the market and chronic government deficits ensures that there will not even be an attempt to meet it.

 

IF YOU BUILD IT

The trouble with affordable housing is that developers won’t build it unless there is a financial incentive. “The only way it works is not in the marketplace,” Welch said. “There’s no such thing as affordable land, affordable sheetrock, affordable architects, or affordable engineers. The profound condition … is that the market cannot produce affordable housing.” As long as developers can make higher profits building market-rate, they will.

That’s why government steps in to subsidize or mandate new affordable housing construction or preserve existing stock. Under the Inclusionary Housing Ordinance, if developers decide not to build the required 15 percent of affordable units, they must pay an in-lieu fee that gets funneled into an affordable housing fund.

In a good year, MOH Executive Director Douglas Shoemaker told the Guardian, the city receives $10 to $15 million from these fees, which is used in partnership with developers to build affordable projects. That system hasn’t worked so well lately. Last year funds for affordable housing were depleted instead of bolstered. Developers who paid their fees in anticipation of building new projects requested refunds after their projects were stalled, Shoemaker told the Guardian, so MOH gave back up to $12 million to developers instead of using that money to build new affordable housing.

This year, Mayor Gavin Newsom introduced what he called an “economic stimulus” program that allowed developers to defer payment of in-lieu fees. This guarantees that it will be a long, long time before new affordable housing can be built using those funds. So as it stands, the inclusionary housing law isn’t so effective at producing new affordable housing.

Projects done in conjunction with the San Francisco Redevelopment Agency, meanwhile, do include higher portions of affordable housing. With all of the planned Redevelopment projects combined — Treasure Island, the Hunter’s Point shipyard, and others — the city can expect to see perhaps 7,000 new affordable housing units in coming years, a portion of which will be condos meant for people in the “moderate” income range. It may well be better than other cities have offered, but it doesn’t begin to address the true need for more than 19,000 units outlined in the General Plan.

Shoemaker noted that San Francisco is a cut above the rest when it comes to affordable-housing requirements. “I just don’t think you could find a city that has more aggressive goals,” he said, noting that in major redevelopment areas, “We’re getting like 30 percent of homes to be affordable on some level.” Yet Shoemaker acknowledged, “the need is intense,” and “there’s more people we would like to serve.”

Olson Lee, deputy executive director of the San Francisco Redevelopment Agency, also described San Francisco as taking a very aggressive stance on affordable housing. Redevelopment devotes 50 percent of its tax-increment financing to affordable housing, where the state requires just 20 percent, Lee said. And some Redevelopment project areas include twice as much affordable housing as is required by state law, he added. “The city has done a tremendous amount of affordable housing,” he said. However, “the fact of the matter is, there’s a greater demand for affordable housing than the number of units.”

From 2005 to 2009, there were 3,607 new affordable housing units constructed, mostly for people at the lowest end of the pay scale, MOH reports. But in that same time frame, 3,465 rental units were converted to condominiums. One could argue that the city essentially broke even with its affordable housing stock in a decade where housing prices almost doubled. As San Francisco housing prices skyrocketed, the city’s 170,000 rent-controlled units served as the saving grace for the majority who couldn’t afford market-rate, and condo conversions continue to threaten the erosion of that very significant housing stock.

Debra Walker, a candidate for District 6 and a tenant representative on the Building Inspection Commission, told the Guardian that she believes a new financing system is needed for affordable housing. “The argument for development is that we get affordable housing money out of it,” she said, but “the inclusionary doesn’t get us enough housing. We cannot include affordable in those high-rises, because they’re so expensive to build.”

She has talked up the idea of a real estate transfer tax that would create a dedicated fund that could then be used in partnerships with affordable-housing developers. Shoemaker, for his part, noted that having a dedicated revenue stream for affordable housing would be very helpful. A committee comprised of the San Francisco Planning and Urban Research Association, Welch, developer Oz Erickson, and Shoemaker was formed earlier this year and actually arrived at a deal, but Newsom ultimately rejected it. Other creative solutions, Walker says, might include reusing shuttered commercial properties or building cheaper by design using different building materials. “It’s about looking at what it is we need,” she said, “and realizing people are in a pinch.”

The greatest complicating factor of the current system, in which the city relies on market-rate development to get new affordable housing, is that even though there a some 40,000 new residential units in the pipeline, developers can’t secure financing to start building them. For now, in the down economy, they only exist on paper.

“They’ll never get built,” Welch predicts, and as long as Newsom continues to extend entitlements for those planned projects in hopes that the market will get a jump, “it’s freezing September 2008 conditions, evidently forever,” limiting opportunities to build something more reasonable.

“They’re zombies,” Welch added. “Who the fuck is going to pay $2 million for a new condo when they can buy a $4 million building for $1 million in foreclosure?” But if the need for affordable housing began to be addressed, he said, something might start to happen. “If you converted half the pipeline units to rental,” he theorized, “they might get built.”

Lynette Sweet’s finances: Curiouser and curiouser

By this time it’s old news that Lynette Sweet, current BART Board Budget Committee chair and District 10 supervisorial candidate, has some issues with the Internal Revenue Service. She owed the IRS taxes going back to the year 2000, and the consequent lien on her property exceeded $20,000 in 2007.

Sweet says she never knew about the lien and thought she’d paid the taxes.

We’re still trying to figure out exactly how this happened — and the trail gets more and more convoluted.

We first called Sweet early in September, after we read about her tax troubles in the Chronicle. When we asked Sweet how she could have been unaware that the IRS was after her, Sweet told us that she’d been working with the tax firm JK Harris. She and Harris reached a deal to pay the IRS $14,500. She told us she bought a cashier’s check at Wells Fargo and mailed it in. But for some reason, she made the check out to herself, not the U.S. Treasury — so the IRS couldn’t cash it.

Normally, when you owe the IRS money, they let you know. But in this case, Sweet says she heard nothing from the feds.

When the Guardian pressed her, Sweet blamed JK Harris for not having forwarded her any of the mail in question. “I gave them power of attorney,” she said. “They had all the communications from the IRS.”

But we reached the the tax firm recently, and the folks there beg to differ. Gina Anton, Director of Corporate Communications at JK Harris, told the Guardian that any mail the IRS sent, it sent to Sweet. JK Harris’s role in Sweet’s tax kerfuffle appears modest — she hired the firm to merely act as intermediary between herself and the IRS.

Said Anton: “Our role was to obtain documents from both her and the IRS to determine what amount she could afford and what the IRS would consider an acceptable amount.”

JK Harris did not cut any checks, or inspect any checks after Sweet had cut them, Anton told us. Just the opposite: whatever documents the firm had prepared for Sweet, they sent to her for approval before forwarding them to the IRS.

Furthermore, said Anton, JK Harris was trying to reach Sweet for two years, after Sweet sent the IRS the dubious cashier’s check that she had hoped would diffuse her tax problem. Sweet finally returned JK Harris’s calls when she found out the IRS could not cash the check.

It’s all pretty odd for someone who’s worked in the banking industy for 22 years.

Questions surrounding Sweet’s finances reach beyond troubles with the taxman. She told us recently that she has worked at two companies that she never listed on her economic interest statements.

In her discloure forms, viewable at the BART Board website, she lists no sources of income after 2004, when she reported that she was employed by BayCAT (Bayview Hunters Point Center for Arts and Technology). However, in a very short and heated interview Sept. 10, Sweet told the Guardian that after she had worked at BayCAT, she had also worked at the African American Interest Free Loan Association and Trans Bay Cable.

In fact, she said she had worked at Trans Bay Cable, which is building an electricity line from Pittsburg to San Francisco,  until May of this year, when she left the company to run for office.

Which raises the question: If she was working all those years, why do her economic interest statements show no sources of income at all from 2004-2009?

The Guardian has attempted many times over the past week to contact Sweet to follow up on that question, but she’s stopped returning our calls or responding to our emails. (She’s also refused to come talk to us for an endorsement interview.)

Here are the questions her campaign has decided not to answer:

1.) What were Sweet’s periods of employment with the African American Interest Free Loan Association and Trans Bay Cable? Did she receive any income for this work? Whether yes or no, would she like to comment on the nature of that work?

2) What was the source of the tax that Sweet owed the IRS? Was this a tax on income? If so, then for income from work with which companies?

3) Why did Sweet elect to pay what she owed the IRS by means of a cashier’s check? (Why not a personal check?)

We’re also wondering why she didn’t list any income on her disclosure forms or why she made the check out to herself.

Every year, the Guardian features the Top 10 Project Censored stories presented by the Sonoma State University project that spends all year analyzing which stories the mainstream media missed. But which stories did not find their way into the mainstream press here in the San Francisco Bay Area?

News outlets other than the Guardian typically ignore Project Censored (unless you count SF Weekly’s snark), so you might say that even Censored tends to be censored. Other than that, we note that issues not hand-delivered via press release or PR campaign might receive less attention than those obvious stories. Using a rather unscientific process of surfing alternative news sites online to find out which stories didn’t get a lot of play in the mainstream, we’ve come up with an assortment of Local Censored stories – though this is by no means a comprehensive list. What other news didn’t make the news?

* What we didn’t hear about when PG&E was pushing Prop 16

Speaking at an informational hearing in Sacramento in February 2010 about Pacific Gas & Electric Co.’s ballot initiative, Proposition 16, former California Energy Commissioner John Geesman noted that the state’s most powerful utility company was using customer money to finance a bid to change the state constitution for its own purposes. Prop 16, which earned a thumbs-down from voters in the June election, would have created a two-thirds majority vote requirement before municipalities could set up electricity services separate from PG&E. While there was no shortage of reporting about the astounding sums of cash that PG&E sank into Prop. 16, hardly anyone aside from Geesman picked up on the more salient point of what PG&E was not spending its money on.

“California’s investor-owned utilities face a Himalayan task in modernizing our electricity system and building the infrastructure necessary to serve a growing economy,” Geesman wrote on his blog, titled PG&E Ballot Initiative Fact Sheet. “They ought to focus on that, rather than manipulating the electorate to kneecap their few competitors.” It is now abundantly clear that PG&E’s aging gas pipelines in San Bruno were badly in need of replacement – and the utility’s neglect opened the door the catastrophic explosion that occurred Sept. 9, resulting in tragic loss of life and destroying homes. “The current leadership at PG&E has lost its way. Nobody is minding the ship,” senator Mark Leno told the Guardian shortly after the blast. “Enough with the self-initiated, self-serving political campaigns. … How about focusing on the current mission — to provide gas and electricity safely, without death and destruction?”

If you looked to Colorlines.com, Blockreportradio.com, the San Francisco Bay View, or Indybay.org for coverage of Johannes Meherle’s murder trial for the fatal shooting of Oscar Grant, then you got a different picture from the one offered by mainstream Bay Area news outlets. There may well be plenty of details about the trial that didn’t make the cut for mainstream news, but one particular point caught our eye as something that should’ve warranted more prominent coverage, or at very least sparked deeper questions from mainstream press. According to the witness testimony of Jackie Bryson, who was with Grant on the train platform the night of the shooting, Grant’s friends immediately urged BART police to call an ambulance after Grant had been shot, but police didn’t do it right away.

Here’s the report from Block Report Radio: “Jack Bryson said he yelled at Oscar after he was shot to stay awake and to the police to call the ambulance. The unidentified officer who was on Bryson declared, ‘We’ll call the ambulance when you shut the fuck up!’ Bryson went on to say that he was never searched on the Fruitvale platform or at the Lake Merritt BART police station, which seems ridiculous if you consider the earlier testimony of former BART police officers Dominici and Pirone, who were involved in the murder and who testified last week that they had felt threatened by Oscar Grant and his friends.” So, if it’s true that Grant’s friends were told to “shut the fuck up” when they were urging BART cops to call an ambulance, and that the supposedly threatening parties weren’t ever searched, why didn’t these points receive as much attention in the media as, say, the claim that years earlier, Grant may have resisted arrest? After witnessing the death of his friend, Bryson said in his testimony, he was detained for hours while wearing handcuffs pulled so tight that his wrists hurt, only to be told afterward that since he had not been read his Miranda rights, he was not under arrest. To be fair, the detail about calling the ambulance did make it into the Chronicle, near the bottom of a blog post, under the subhead, “Friend’s claim.”

* Homelessness on the rise in San Francisco

The controversy surrounding Prop L, a proposed ordinance to ban sitting and lying down on the sidewalk, has been widely reported on — but there’s a more pressing issue related to homelessness that hasn’t gotten nearly as much ink. An article in New America Media, “Shelters predict homeless count to skyrocket,” highlighted a perceived surge in San Francisco’s homeless population, evidenced by overwhelmed service providers who can hardly keep up with demand. “We’re serving 200,000 more meals per year than two years ago, but we haven’t had the capacity to add staff,” the chief executive officer of the Glide Foundation noted in the article. The drop-in center, she added, no longer had enough seats to accommodate those in need. According to a fact sheet issued by the Coalition on Homelessness in July of 2009, 45 percent of respondents to a COH survey were experiencing homelessness for the first time. The overwhelming majority of respondents, 78 percent, became homeless while living in San Francisco.

* The long wait for Section 8

It isn’t easy for a tenant with a Section 8 voucher to find housing in the San Francisco Bay Area. In San Francisco, there’s a barrier to getting the voucher in the first place, since the waitlist is currently closed. Those who have vouchers are often passed over by landlords, and the string of denials can drive people to unstable housing situations such as extended hotel stays. An article in POOR Magazine features the story of Linda William, a woman who left a San Francisco public housing project with a Section 8 voucher in hand only to embark on a wild goose chase, ultimately winding up in a low-end motel outside Vallejo. “Well whaddya know,” William told the POOR magazine reporter, “I found closed wait lists on almost all the low-income housing units in all of those places and all the rest of the landlords wouldn’t even return my calls when I told them I had section 8.” An article by Dean Preston of Tenants Together that appeared in BeyondChron, meanwhile, spotlights the issue of landlord discrimination against Section 8 tenants.  “In the Section 8 voucher program, participating tenants pay 30 percent of their rent and the Housing Authority pays the balance to the landlord,” Preston writes. “It takes years for eligible tenants to be able to participate in the program. Once tenants get off the wait list, the landlord must sign a payment contract with the housing authority in order to receive the portion of the rent paid by the government. By refusing to sign onto the program, some landlords seek to force rent controlled tenants into situations where they cannot pay their rent.”

* San Francisco’s trashy secret

Despite being thought of as a beacon of sustainability, San Francisco’s not-so-green waste stream is something that didn’t make the front page of many papers – except, of course, this one. Sarah Phelan’s “Tale of Two Landfills,” a Guardian cover story this past June, examined San Francisco’s decidedly unenlightened policy of transporting waste far outside of the city despite a goal of reducing waste to zero in the next 10 years. Here’s an excerpt: “It’s a reminder of a fact most San Franciscans don’t think much about: The city exports mountains of garbage into somebody else’s backyard. While residents have gone a long way to reduce the waste stream as city officials pursue an ambitious strategy of zero waste by 2020, we’re still trucking 1,800 tons of garbage out of San Francisco every day. And now we’re preparing to triple the distance that trash travels. ‘The mayor of San Francisco is encouraging us to be a green city by growing veggies, raising wonderful urban gardens, composting green waste and food and restaurant scraps,’ Irene Creps, a San Franciscan who owns a ranch in Wheatland, told us. ‘So why is he trying to dump San Francisco’s trash in a beautiful rural area?’”

* The real unemployment rate

The Bureau of Labor Statistics makes a distinction between so-called “discouraged workers” who have stopped looking for jobs, and the jobless who are actively seeking employment, so the official unemployment rate (9.7 percent in San Francisco, according to the most recent data) may be much lower than the actual unemployment rate.

We haven’t seen any brilliant local reporting on this issue, but the problem is summed up nicely in this YouTube video produced by a personal finance software firm.

Chron endorsement dishonestly attacks marijuana measure

Once again proving itself to be an corporate-run embarrassment to a city that has been at the forefront of progressive reform – including the movement to legalize medical marijuana – the San Francisco Chronicle this morning recommended that voters reject Prop. 19, which would allow cities and counties to legalize marijuana use by adults. And it did so with tortured logic and a cowardly, disingenuous claim to support legalizing marijuana.

As a journalist who has covered the medical marijuana industry in the Bay Area, I didn’t recognize the chaos that Chron editorial writers say resulted from the landmark 1996 measure Prop. 215, the medical marijuana measure written right here in San Francisco, home to a well-regulated, professional network of cannabis dispensaries, thanks to the city proactively setting guidelines. The cities cited in the Chron all did nothing to set standards for medical marijuana dispensaries, whereas in cities like San Francisco that did, an increasingly important sector of the local economy flourished with few problems.

Prop. 19 would similarly allow cities and counties to create systems for regulating marijuana for recreational use – or to not allow it if they so chooses. Yet the Chron takes issue with this localized approach, writing, “The measure establishes no state controls over distribution and product standards; it does nothing to help cure the state’s budget deficit.”

Both statements simply aren’t true. The measure explicitly gives the state authority to tax and regulate marijuana, Assembly member Tom Ammiano already has proposed legislation to do so if the Prop. 19 passes, and the California Legislative Analyst’s Office has estimated it could bring in more than $1.5 billion annually into state coffers.

Although the Chron claims “that the ‘war on drugs’ – especially as it applies to marijuana – has been an abject failure,” it bemoans a provision in the measure that prevent employers from firing employees simply for having marijuana in their systems, as it would be if someone smoked a joint three weeks ago, despite having no impact on job performance. “Pre-employment testing would be banned,” the Chron writes, as if that were a bad thing. The editorial also complains that people would be allowed to grow small plots of marijuana in their backyards. Again, and the problem with that is what exactly?

Bottom line: Chron editorial writers fall into the same old tired reefer madness stereotypes that have driven the drug war’s “abject failure,” but they just aren’t honest enough to admit the contradiction with their stated claim that “if this were simple a referendum on the status quo, and the ability of a 21-or-older Californian to possess an ounce or less for personal use, it might be an easy ‘yes’ vote.”

Because the reality is that’s what this measure does, simply lift the prohibition on pot, while also including language supporting local control and basic civil rights. There are some valid arguments against Prop. 19 – such as it lets jurisdictions tax or regulate pot too much – but those honest disagreements weren’t raised by the newspaper.

Instead, the paper made it sound like measure would fill the roads with stoned drivers and every neighborhood with the stench of marijuana, which is laughably alarmist. San Francisco’s experience with medical marijuana should serve as an indicator. This city has been the most accepting and legitimizing of marijuana for decades. It’s part of our culture. But drug surveys from our school district and others show that the rate of marijuana use among young people here is lower than the state average, and we have been at the forefront of world-renowned technological innovation and academic research, so clearly the normalization of marijuana hasn’t corrupted our youth or turned us all into menacing zombies.

The Chronicle’s presentation of the issue, and its recommendation on this measure, are anachronistic throwbacks to another era and should be tossed into the dustbin of history where they belong.

Labor Day heroes

Let’s pause for a moment this Labor Day to recognize some of our most important, yet most maligned workers.

They’re teachers and librarians, police officers and firefighters.  They’re bus drivers, doctors and nurses. Judges and lawyers, landscape gardeners and arborists. They’re laborers and other maintenance and construction workers . . .

They are, of course, public employees. There are millions of them, who every day perform many thousands of the essential tasks that keep our country going.

It is they who keep our streets and highways, our parks and playgrounds safe and clean, who help educate our children, provide emergency health care, convey us to our jobs and back home, who sometimes risk their very lives to protect us from harm.

Yet for all that, public employees have come under heavy bipartisan attacks by political leaders and would-be leaders who find them an easy target to blame for the budget shortfalls that beset government at all levels. Labor costs, after all, make up the bulk of government spending everywhere.

The politicians and too many others who benefit from the public employees’ services – and, in fact, demand the services – say public employees are paid too much and their fringe benefits are way too generous, especially their pensions.

The employees’ pay and benefits were in most cases the result of democratic give-and-take collective bargaining and are guaranteed in union contracts that their government employers agreed to, sometimes after a long and difficult struggle by the workers.

But that was then, this is now. This is a time to make scapegoats of public employees, to shift the blame for economic troubles to them.

Public servants they were then, but public enemies they are now in many quarters, where they’re characterized as overpaid and underworked members of greedy and much too economically and politically powerful unions.
Their unions are now in the vanguard of the labor movement, growing larger and stronger while other unions shrink, and becoming serious new threats to anti-labor forces on Wall Street and elsewhere that seek profit from the work of others in private and public employment alike.

There’s no legitimate reason for any government entity to finance operations at the expense of its employees, whose jobs are among the nation’s most important, or to deny  them much deserved pay and benefit increases.  There’s plenty of money available to cover the costs.

And where is that treasure trove to be found?  Where else but in money-hungry corporate America. It’s simple. Repeal the huge tax cuts that President Bush and his corporation-loving, union-hating Republican colleagues bestowed on their wealthy friends.

That would bring in an estimated $3.75 trillion over the next ten years and just about erase the federal budget deficit.  But that’s not going to happen as long as Republicans retain enough votes in Congress to wage a filibuster.

GOP leaders would rather try to reduce the deficit by such outrageous steps as raising the Social Security retirement age from 67 to 70, and thus deny much-needed benefits to millions of the working class Americans who we honor on Labor Day.

None are more deserving of our appreciation, none more deserving of being honored than the men and women who do the work of government that benefits us all.

SEIU and the new McCarthyism

OPINION More than 43,000 California health care employees are currently involved in the largest union election in private industry since the 1940s, a contentious campaign that pits officials of the Service Employees International Union (SEIU) against the National Union of Health Care Workers (NUHW). The outcome of the election may well determine the future of the labor movement for years to come.

The leaders of NUHW (the interim president is Sal Rosselli) are the same organizers who inspired and united us in achieving a historic victory: the five-year Kaiser Permanente contract of 2005-10. Health care workers all over the state depend on the benefits enumerated in that contract, including employment and income seniority, paid retirement, paid family health care, and employee participation in staffing and health care issues. The contract is still considered the national gold standard for hospitals.

A few years ago, our union, part of SEIU, was united and strong. The nurses, lab technicians, secretaries, operators, environmental service personnel, x-ray technologists — we were all proud to work together in a noble enterprise, fostering and saving human life. Today, SEIU is in disarray.

The decline began when Andy Stern took power in Washington. He established absentee rule of California. After he withdrew SEIU from the AFL-CIO (which prohibits union raids of other unions), Stern launched a series of raids on two sister unions, UNITE HERE and the Puerto Rican Teachers’ Union. The San Francisco Labor Council (along with the AFL-CIO) formally denounced the Stern raid on UNITE HERE. The raid cost our members millions of dollars. Stern then moved against our California locals, particularly United Healthcare Workers-West, led by Rosselli. Rosselli was the leading champion of democratic unionism in the state. In defiance of the wishes of our membership, Stern fired Rosselli.

The bitterness and hostility within our union today are a direct result of Stern’s mass purges. One hundred elected members of the executive board were removed by fiat. Hundreds of elected shop stewards were dismissed. Subsequently, 48 other stewards resigned in protest of the autocratic policies of the national office. The standard joke at California Kaiser worksites is, “Got a grievance? Call Washington!” Juan Gonzalez, the widely read columnist for the New York Daily News, called the Stern blitz “a stunning assault on democracy within his own union.”

SEIU represents a new kind of McCarthyism in the labor movement, a trend that threatens the unity of labor as a whole.

SEIU bully tactics to prevent workers from joining NUHW are so widespread, so well-documented, that Dolores Huerta, cofounder of the United Farm Workers, sent an open letter to SEIU President Mary Kay Henry, who succeeded Stern after he retired. Huerta complained that “every time workers met to talk about NUHW, SEIU staff surrounded them and began chanting and yelling insults, refusing to let workers talk.”

Even the homes of workers are not off limits. In Fresno, local TV stations (just Google “TV Coverage of SEIU Threats”) documented SEIU pressure tactics during house visits, after workers received their ballots in the mail.

The demise of our once great union has implications far beyond our locals in California. If California’s most successful, democratic labor organizers can be overthrown, If elected shop steward networks (shop stewards are the backbone of union democracy) can be dismantled by fiat, if Washington can establish absentee rule of locals from 3,000 miles away, no union is safe, and American democracy itself is diminished.

Herrera’s gang injunction becomes part of D. 10 dialogue

As stated in this week’s article about City Attorney Dennis Herrera’s Viz Valley gang injunction, Herrera’s move gives D. 10 candidates an opportunity to show they are tracking all the issues in a district that is home to the city’s largest public housing site.

As C.L.A.E.R. Project director Sharen Hewitt put it at a debriefing session about the injunction, “D. 10 has been reduced to the Lennar issue, and that’s what’s criminal.”

And the injunction is becoming part of the dialogue in the D. 10 race, with eleven candidates in that race sounding off on the injunction, many of them critiquing Dennis Herrera’s approach and/or advocating for legal representation for those named in the suit, and more services in this historically neglected district.

Candidates Isaac Bowers, Kristine Enea, Chris Jackson, Nyese Joshua, Steve Moss and Marlene Tran attended Hewitt’s August 12 gang injunction debriefing.

And by meeting’s end, Bowers and Enea said they would help community members get legal representation.
“A lot of people being served, don’t know what an injunction is, or don’t show up at the hearing and then they become subject to the injunction,”  Bowers said.

Enea said she was glad that City Attorney Yvonne Mere clarified at the debriefing that the 41 young men named in Herrera’s filing could not be included in the actual injunction until they have been served.

“It was important to clarify the notice process,” Enea said.

Jackson said he’s committed to helping these men access job and education opportunities.
“If you i.d. folks as low-income gang members, there is a lot more you can do than simply hand over their names to law enforcement,” Jackson said.
“Before the City Attorney puts in a gang injunction, that office should talk about it with the community.” Jackson continued. “Ultimately this is about land use.”

“For the City Attorney to have a top down approach to gang injunctions is unfortunate,” Jackson said, noting that Herrera’s injunctions have been in predominantly
African American and Latino neighborhoods.

“And in terms of taking away people’s civil rights, it’s unacceptable, “ Jackson added, noting that the City Attorney’s list of targeted individuals is public information.

Reached by phone, Moss says he’d like to see a time limit imposed on gang injunctions. Currently, injunctions are indefinite, once they have been granted.

“I haven’t studied the precise details,” Moss said, noting that he went to Hewitt’s debriefing and has leaved through materials the City Attorney’s Office provided.
“Generally, no one likes gang injunctions because they potentially threaten civil liberties and sometimes the city gets it wrong,” Moss said, referring to cases where folks have been wrongly named in previous injunctions. “But in places where injunctions have been brought, they do seem to have reduced the violence and calmed down the district. I’d like there to be a time limit, a sunset clause.”

D. 10 candidate Marlene Tran said she thinks the injunction could help reduce violence in the neighborhood.
“I was trying to listen to the different input at the debriefing session,” Tran said. “But on TV, I heard that when Herrera talked to the Chinese press, he cited some 200 incidents in the proposed safety zone. About 100 of those incidents involved guns, and there have been ten homicides in three years. Those are really glaring statistics. And this morning I read that there is another injunction in Oakland, and they talked about success with gang injunctions in Salinas, where the homicide rate dropped from 50 to 5, compared to 2008/2009.”

Tran, who sits on the Community Advisory Board for the Police Department’s Ingleside Station, said she heard from Ingleside Captain Louis Cassenego that he wants to serve all 41 respondents named in the injunction peacefully.
“If this is done without any casualties to the district and the community, and if it prevents any further violence, then this is the way to go,” Tran said.

Tran expressed some due process concerns.
“If they spend that much personnel and time [on putting the injunction together], it should be done with due process,” Tran said.

But she feels the current level of violence in Viz Valley is unacceptable.
“I’ve lived here for twenty something years, and if you talk to residents and children, who wants to hear gun fire,” Tran said. “So I think we have to work for a peaceful community to prevent these problems. That’s why we call ourselves the emergent district.”

D. 10 candidate Ed Donaldson believes the injunctions are a product of neglect.
“It comes back to a question of overall neglect in the district,” Donaldson explained.  When you have that level of social and economic neglect, gang injunctions become “necessary’. But when you look at the resources coming into the district through local non-profits, which comes, I believe to $110 million a year, 80 percent of which is city money, paid mostly to non-profits that may not be based in the district, you have to ask, Are we getting what we paid for? And do these non-profits have enough integrity to make sure there is a level of impact to transform people’s lives? “

Donaldson says that, given the overall level of neglect in public housing, it’s not surprising the district has challenges.

“So, are we willing to invest in the neighborhood in a very transformative way, or are we going to continue to give money to police and prisons?” Donaldson asked.
He notes that every year, 1,600 men and women return to the southeast side of San Francisco, and there is a 71 percent recidivism rate among these folks.

“Why is this rate so high in a progressive city like San Francisco?” Donaldson said. “Part of the answer lies with our public housing policy: if you can’t get public housing, you can’t apply for a job, you can’t go to school to better yourself.”

Donaldson says there is a direct connection between the district’s homicide rate and the people getting out of prison, returning to the district and re-offending.
“So, what’s so hard about getting our arms around 1,600 people a year and stabilizing them? Because then a lot of stuff about public safety will go away.”

D. 10 candidate Tony Kelly believes that if there were gangs in Viz Valley, then Herrera’s injunction would be valid.
 “There is gang-like activity, but it’s small scale turf wars, shootings and retaliations, and it’s not organized,” Kelly said. “ Instead, you’ve got unorganized young black men with no other options, doing whatever it takes to get ahead. But instead of doing something constructive, the City Attorney calls them gangs.”

Kelly notes that the City Attorney claims that most of the individuals named in the Viz Valley injunction don’t live in the proposed safety zone.
“But according to what I’m hearing on the ground, a bunch of them do live here and/or grew up here,” Kelly said. “So, we want their families to get involved. They need safe havens. But combined with last year’s budget cuts, all this does is criminalize young people and pushes the problem around. As long as we have 40-50 percent unemployment, we are not going to solve our crime problem.”

DeWitt Lacy, also a D. 10 candidate, said he is concerned that gang injunctions are circumventing people’s due process rights.
“In a criminal case, you have the right to an attorney, but that’s not so in a civil action,” Lacy said.

Lacy worries that gang injunctions lend themselves to racial profiling.
“Folks have to stay in their house or quickly go to and fro because they can’t hang out in the neighborhood,” Lacy said. “A smarter approach would be to do community policy that Sup. Ross Mirkarimi introduced in the Western Addition. It’s been shown to have a positive impact on criminal activity. We should have officers walking around in troubled areas. The more we change a foot patrol pilot into citywide policy, the more we actually address serious issues and problems. Everyone understands the value that police bring and everyone wants to be able to rely on them. When we only use police to bring a punitive action it reinforces the notion that they are evil enforcers.”

D. 10 candidate Malia Cohen said she was concerned by Herrera’s approach.
“I think we need a more comprehensive approach, otherwise, we’ll simply be moving crime two blocks over,” Cohen said. “We need long-term, not short-term solutions.”

Cohen noted that there are Chinese and Russian gangs in town, as well as African American ones, and Latino gangs like the Nortenos and Sudenos.
“But the style of how each gang manifests is different, which makes African Americans an easy target. We need to have a uniform approach to how we deal with this.”

The 41 men identified in Herrera’s latest injunction all appear to be African American, and many have family ties and roots in Sunnydale, meaning the injunction impacts a much larger circle of folks than those simply named in Herrera’s filings.
“The impact on families caught up in this can’t be overstated,” Cohen said.  “Either they’ll have to take bus down to court, or drag down and pay hella money for parking, and for food, and even take a day off from work if they are employed. And then there’s the emotional effect. We could be using our resources in a more productive way. I understand that Dennis Herrera is ambitious, but this is playing on people’s racism. It’s tantamount to ethnic cleansing. Maybe Herrera wants to be seen as tough on crime, but ut how about being seen as big on compassion? Or big on fair? This is not going to help people get jobs and housing. And it prevents American citizens from being able to travel.”

Eric Smith, also a D. 10 candidate, says it’s right to question the injunctions.
“David Campos and Eric Quezada both expressed concerns about Herrera’s injunction against the Nortenos, when they were running in the 2008 race for D. 9,” Smith observed.
“They talked about the unintended consequences of that injunction in terms of deporting folks who then train the next generation in the ways of gangs.”

Smith questions how effective gang injunctions are in the long-term.
“They are a band-aid,” Smith said. “This is like putting a finger in the dike, or using a hammer to kill a flea. Because the root causes are not addressed. If you don’t deal with young people’s lack of education and joblessness, their hopelessness, their choicelessness, the gang becomes their family. So, if the city did community policing and had great youth programs, it would help.”

Smith, who is a professional jazz musician, wants to see more music, poetry and spoken word programs and activities in the neighborhood.
“There’s a lot of untapped talent,” he said. “When you have arts, music and theater, those are life-saving opportunities.”

Also a bio-diesel advocate, Smith wants to see people who are returning to the community after a stint inside, being able to access green jobs, instead of doing more of the same stuff, only better, than the activities that landed them inside in the first place.

“I care about everyone in the district, but most of all about those who have been kicked to the curb and end up in gangs, on drugs, or dead.”

And D. 10 candidate Diane Wesley Smith believes there are better solutions than gang injunctions

“African American culture is almost opposite in terms of physical mannerisms and gestures and tone of voice, and that can be scary to someone who is used to being conservative,” Wesley Smith said, speaking to the rising tensions between some black and Asian residents in the district.

“I believe these things could be solved with town hall meetings, where there is food and translators so folks could talk things out, “ she said. “It’s never going to be worked out through the police. Only law enforcement benefits from these kinds of proceedings. We need to reach out and touch each other, so that the Chinese community knows that the black community has the same goals as they do, which are employment, housing and safety.”

“When we talk about violating people’s civil rights, posting people’s pictures on websites, preying on people’s fears, well, that’s how we got into the war,” Wesley-Smith said. “Unemployment. Lack of access to opportunity. Lack of education. No money for our schools, but an increase in spending on our jails. These all send the same message: You are not wanted.”

Wesley Smith is concerned that the gang injunctions will accelerate the mass exodus of blacks and people of color from San Francisco.
“We all want a safe San Francisco,” she observed. “The solution is more jobs, not war. People are just going to go more underground in face of these injunctions. Meanwhile, the kids in my district don’t have toilet paper or computer paper in their schools.”

“I understand that Dennis Herrera is a career politician, and time will tell what his true aspirations are, but this is not legislation we propose in a caring society,” Wesley-Smith concluded. “We’re not showing any of these kids any love. All we need to do is partner with business and government and work this out. Te thought that four men standing on a corner drinking an energy drink could be considered gang members is shocking. That’s how they perpetuated slavery, and that’s why blacks have problems today. All my nephews dress similarly. So, are we going to consider them gang members? The good and the bad kids dress the same. We need people and parents to understand that none of us can be safe, until we take care of those who have the least in our community. I’d venture that everyone who is a safety concern has not pursued their education, has not been assisted in pursuing education, and has not been assisted in pursuing employment.”

Immigrant advocates accuse ICE of “pattern of dishonesty”

A coalition of national civil rights organizations held a August 10 press conference to discuss recently released internal government documents that they say reveal “a pattern of dishonesty” regarding Immigration and Customs Enforcement (ICE)  “Secure Communities” (S-Comm) program.

Representatives with the National Day Laborer Organization Network (NDLON), the Center for Constitutional Rights (CCR), and the Kathryn O. Greenberg Immigration Justice Clinic of the Benjamin N. Cardozo School of Law noted that though ICE officials have declared their intention to expand S-Comm into every jurisdiction in the country by 2013, information about the program has been scarce, and development of its operational details has been shrouded in secrecy.

The coalition also pointed to a July 27 letter that U.S. Congresswoman Zoe Lofgren recently wrote to Secretary Janet Napolitano and Attorney General Eric Holder as evidence that ICE led Congress to believe that SecureComm is a voluntary, and not a mandatory, program.

In her letter, Lofgren, who is chair of the House of Representatives’ subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law,  asks for “a clear opt-out procedure for municipalities that do not wish to participate in the S-Comm program.”

“As we discussed, Secure Communities is a voluntary program that relies upon the resources of both of your agencies [referring to DHS and DOJ] in order to provide State, local, and federal law enforcement agencies with information related to the immigration status of persons booked into our nation’s jails and prisons,” Lofgren wrote.

“I am aware that some local law enforcement agencies have expressed concern that participating in Secure Communities will present a barrier to their community policing efforts and will make it more difficult for them to implement a law enforcement strategy that meets their community’s public safety needs,” Lofgren observed.

“There appears to be significant confusion about how local law enforcement agencies may ‘opt out’ of participating in Secure Communities,” Lofgren continued.

Lofgren notes that staff from her House subcommittee were briefed on this program by ICE and were informed that localities could opt out simply by making such a request to ICE, while subsequent conversations with ICE and FBI CJIS added  to the confusion by suggesting that this might not be so.

“Please provide me with a clear explanation of how local law enforcement agencies may pot out of Secure Communities by having the fingerprints they collect and submit to the SIBs checked against criminal, not immigration, databases,” Lofgren concludes.

To date, Lofgren has not received a reply, a press spokesperson in her office confirmed.

Immigration rights advocates charge that S-Comm, which is operative in 544 jurisdictions in 27 states, functions like the controversial 287(g) program and Arizona’s SB1070, making state and local police central to the enforcement of federal immigration law.

They say the program, which automatically runs fingerprints through immigration databases for all people arrested, targets them for detention and deportation even if their criminal charges are minor, eventually dismissed, or the result of an unlawful arrest.

After reviewing the recently released ICE documents and other information, advocates for NDLON said they found evidence supporting their claim that ICE has been dishonest with the public and with local law enforcement regarding S-Comm’s true mission and impact.

“While ICE markets S-Comm as an efficient, narrowly tailored tool that targets ‘high threat’ immigrants, it actually functions as a dragnet for funneling people into the mismanaged ICE detention and removal system,” stated a NDLON press release. “ICE’s own records show that the vast majority (79 percent) of people deported due to S-Comm are not criminals or were picked up for lower level offenses.”

They also charge that the program serves as a smokescreen for racial profiling, allowing police officers to stop people based solely on their appearance and arrest non-citizens, knowing that they will be deported, even if they were wrongfully arrested and are never convicted.

“Preliminary data confirms that some jurisdictions, such as Maricopa County Arizona, have abnormally high rates of non-criminal S-Comm deportations,” NDLON continued.

 “Lastly, the impression ICE fosters that S-Comm is not mandatory and jurisdictions can opt out is riddled with questions,” they conclude.

 “These records reveal a dangerous trend,” said NDLON Executive Director Pablo Alvarado. “This program creates an explosion of Arizona-like enforcement at a time when the results have proven disastrous. Thanks to S-Comm, we face the potential proliferation of racial profiling, distrust of local police, fear, and xenophobia to every zip code in America.”

 “S-Comm co-opts local police departments to do ICE’s dirty work at significant cost to community relations and police objectives,” said CCR attorney Sunita Patel. “Without full and truthful information about the program’s actual mission and impact, police are operating in the dark. The bottom line is that thrusting police into the business of federal immigration enforcement isn’t good for anyone.”

 “ICE is racing forward imposing its S-Comm program on new states and localities every day, without any meaningful dialog or public debate,” warned Bridget Kessler, a teaching fellow at the Immigration Justice Clinic of the Benjamin N. Cardozo School of Law.

The three organizations vow to litigate for the release of more data and records “to uncover the truth behind S-Comm and other ICE efforts to draft local police into immigration enforcement.”

Also speaking at the Aug. 10 press conference was San Francisco Sheriff Mike Hennessey. Earlier this summer, Hennessey blew the whistle on S-COmm, after attending a meeting in May at which ICE revealed it was going to switch the program on in San Francisco in June.

But despite Hennessey’s efforts to opt San Francisco out of the program, S-Comm went live June 8 in San Francisco.

“We were told we could opt out through the State Attorney General’s Office,” Hennessey said, recalling how AG Jerry Brown’s office told him that San Francisco could only opt out through the feds.

“We were given the run around,” Hennessey said.“It’s a program forced upon individual local law enforcement agencies, no matter what the local community wants,” Hennessey said.

Henessey worries that the program is having a chilling effect on community policy efforts.

“Witnesses and victims of crime won’t come forward for fear they will be deported,” he said.

Henessey notes that ICE has detained folks who were arrested for minor traffic violations, and whose charges were subsequently dropped, as well as folks with no criminal records.

“My Board of Supervisors, my Police Commission and my mayor have said they would rather not participate in deportations at that level,” Hennessey noted.

He worries that the program could be expanded to include employment record checks.

“They say the program won’t be used for civil purposes, but it’s already being used for federal employment checks,” Hennessey said. “This further isolates minority communities from the mainstream.”

Reinventing San Francisco

OPINION It’s hard to trust hope these days — to imagine that our world, or even our city — could be different. But for the next 10 or 15 minutes, as you read this, we invite you to suspend the cynicism and disbelief that hang over contemporary life, and allow your mind to imagine that, yes, a different San Francisco is possible. Just for 15 minutes, although we hope this helps kick-start a much longer-term revival of hope and urban reimagining.

It’s time to create something new in San Francisco — a visionary movement for constructive change that’s bold and unapologetic. Imagine, for instance, if San Francisco became a national model for how cities can reinvest local profits (public and private) and assets to expand economic opportunity and social equity. Imagine if, instead of promoting a dispiriting and volatile blend of corporate development and Darwinian “free-market” anarchy, San Francisco transformed how American cities define success by creating concrete alternatives to the chaos of capitalism.

Now imagine that San Francisco had its own public bank — a fiscally solvent, interest-generating financial force (potentially a half-billion dollars strong) dedicated to public financing and economic stimulus, that functioned as a vigorous incubator for homegrown industries and sustainable, true-green job creation.

We are proposing no less than a reinvention of San Francisco — a dramatic shift in priorities, resources, politics, and culture that marries the very best in both creative innovation and urgently needed reforms to make our city socially equitable and sustainable, both ecologically and economically.

Toward this end, the Community Congress, Aug. 14-15 on the University of San Francisco campus, will stimulate ideas, discussion, and planning to reinvigorate civic engagement and inspiration and create a concrete, locally actionable agenda for reshaping the city. The congress is a conversation starter and idea incubator — an opportunity to begin reimagining San Francisco as a socially equitable, racially inclusive, ecologically sustainable city that grows its own food, supplies its own energy, and is an affordable haven for working-class people, immigrants, artists, and creative folk of all stripes.

We humbly propose a city that embraces cosmopolitanism and international exchange while empowering its residents to achieve a decent and livable quality of urban life. We are not trying to turn back the clock; we are trying to create new forms of social and economic value that give people meaning and sustenance, and hope.

 

WHY A COMMUNITY CONGRESS—WHY NOW?

Couldn’t we save such sweeping aspirations for a rainy day? The sky isn’t falling yet, is it? Not quite, but the present constellation of crises San Francisco is ensnarled in — massive and rising structural deficits, a boom/bust economy that’s profoundly unstable and inequitable, deepening economic and social divides that destabilize communities, to name a few — is simply unsustainable.

San Francisco’s economic and fiscal crisis is not a passing moment. Rather, it signals long-term structural flaws in the city’s economic policies and planning. San Francisco has lost roughly 45,000 jobs since 2000, and each “recovery” is marked by steadily higher unemployment rates (currently resting at 9.2 percent). More critically, as jobs and wages have grown more precarious and housing prices have steadily risen (over the long term), thousands of San Franciscans have been displaced.

Any serious vision for change must incorporate race and class dynamics. Consider the economic evisceration of much of the city’s African American population, which has plummeted from 13.4 percent of the population in 1970 to just 6.5 percent today (more than 22,000 African Americans left the city between 1990 and 2008). The gutting of communities of color is intrinsically intertwined with issues of job and wage loss and soaring housing costs. This is particularly acute in the geographic and political dislocation of African Americans in San Francisco. Add to this picture intense overcrowding and poverty in Chinatown and in Latino and immigrant communities, and you get a set of inequities that are morally unacceptable and socially untenable.

Like other major American cities, San Francisco faces a crucial historical moment. Global warming and fast-dwindling oil supplies require a transformative shift in how we conceive (and implement) economic development far beyond the city’s current piecemeal approach to “green procurement.” The Peak Oil Preparedness Task Force, appointed by the Board of Supervisors in 2007, concluded that a full 86 percent of San Francisco’s energy use comes from fossil fuels, primarily petroleum and natural gas, and a small amount of coal. Given the world’s fading oil supplies and mounting climate chaos, this is simply unsustainable.

The specter of a looming energy and environmental crisis, combined with economic instability marked by persistently high unemployment, rising income inequality, systemically entrenched homelessness, consumer debt, and the deepening crisis of cutbacks to critically needed human services and affordable housing call for a radical shift in how society — and San Francisco’s economy — are run.

Transforming San Francisco into a truly sustainable city will mean dramatic shifts in what (and how) we produce and consume, and aggressive city policies that promote local renewable energy. Our economy — how our food, housing, transportation and other essential goods are made — will have to be rebuilt for a world without oil.

These and other limits mean we must redefine growth and profit—fast. Work and sustainability must become fully intertwined, and we must think creatively about how jobs can produce social and community value, instead of profits concentrated at the top.

Creating truly sustainable and equitable cities for the 21st century will also mean dramatic shifts in how we produce and consume. There is no better place to begin than here in San Francisco, long an incubator in progressive thinking and genuine grassroots action and innovation. In an earlier Community Congress in 1975, residents and groups from across San Francisco united in a movement of ideas and organizing that led to district supervisorial elections and successful campaigns to stem the tide of downtown corporate development, helping to democratize politics and economics in San Francisco.

The 2010 Community Congress is aimed at reinvigorating local movements for lasting change, both on the policy level and in the relationship between people and their government. We hope to inspire a spirited and creative shift in the city’s culture and politics — with concrete, politically actionable policies to democratize planning and development and a more sweeping transformation of our expectations — toward a far richer and deeper engagement of people and communities in their own governance.

 

A NEW FRAMEWORK FOR URBAN DEVELOPMENT

What would this City of Hope look like, and how would it work? Consider what we could accomplish with a municipal bank. The City and County of San Francisco currently has almost $2.6 billion in highly liquid reserves, about $500 million of which could be used to fund a Municipal Bank of San Francisco. Once established (and federally insured), the Municipal Bank could take additional deposits and use this to issue more loans. The bank could promote economically viable worker-run cooperatives that produce goods and services addressing community needs — be it day care, urban gardening, or ecologically sustainable light industry that creates meaningful employment for local residents. The bank could provide competitive small-interest loans to help stimulate small-business development — the key economic engine of the city. Currently, access to credit is one of the primary impediments to small business growth in San Francisco.

The city could also start a Municipal Development Corporation to produce goods and services that meet essential needs, boost local employment, and generate surpluses that would be available for local reinvestment. San Francisco could launch itself on the path to local energy self-reliance with funds from the Municipal Bank, together with revenue bonds—raising large pools of capital to finance large-scale alternative energy investments such as solar panels to generate energy for sale to local businesses and households.

The proceeds could help subsidize community-based development such as urban farming projects that could grow food for our public schools. The Municipal Development Corporation could explore other initiatives like large-scale medical marijuana cultivation and development of a commercial fiberoptic network. Other ideas can be developed; we need to engage our collective imagination to envision what can exist if there’s enough people power and political will.

By expanding access to credit, municipalizing a chunk of the city’s assets, establishing an economically viable municipal development enterprise, and democratizing city planning and development, San Francisco can enable long-disenfranchised communities to create sustainable and diversified development — instead of fighting over “jobs versus the environment” and other false choices and getting nowhere for decades.

It’s time for proactive, community-led economic development that addresses urgent needs, from local hiring and training, to creating a diverse base of neighborhood-serving businesses, to ecologically sustainable and healthful development and planning that is driven by communities and residents.

San Francisco’s job creation policies can be transformed to prioritize community needs over corporate profits by linking major development contracts to strict local hiring and training, community benefits agreements that invest in social goods like childcare and in-home health services, and ensuring dramatic increases in the city’s stock of affordable housing.

We need to build new forms of public participation in local government in ways that address people’s everyday needs. For instance, the congress will propose a new partnership between residents and Muni to make Muni work better, involving current riders and drivers in a new, more powerful role in how Muni lines function.

We need to find better ways to sustain a diverse population of working-class, people of color, artists, writers, musicians, and others. We need to make sure development isn’t just code for finding new ways to gentrify neighborhoods and displace existing residents.

Specific proposals will address how the city and community-based nonprofits deliver critical health and human services to our neediest residents. We propose making this an integrated part of the budget process, not a last-minute afterthought. Toward this end, the Community Congress will present actionable proposals to create innovative “resident/government” partnerships to improve local government responsiveness and efficiency.

 

RAISING—AND SPENDING—THE BENJAMINS

One of the keys to unlocking the city’s stagnating economy is progressive revenue generation and more democratic participation in budgeting. We must enlarge the public pie while reapportioning it in a way that stimulates job creation and shifts the tax burden onto the large businesses that reap vast private benefits from public goods and services. The city’s budget process must be dramatically reshaped and democratized. Communities need a seat at the fiscal table when the budget is being crafted — instead of lobbying tooth and nail at the end of the process just to retain funding that barely keeps programs afloat.

How can we build a participatory budgeting movement that brings residents and communities into the process? For instance, community budget councils composed of elected and appointed residents from every supervisorial district could assess neighborhood needs and incorporate them into drafting the budget. Whatever form this takes, the goal is to put the needs of residents at the forefront of how the city spends its resources.

The Community Congress can also help redefine fiscal responsibility. Taxing and spending must be accountable and transparent and respect the fact that this is the public’s money. Let’s be honest: much of what passes for government excess is due to management and executive bloat at the top, not salaries of frontline workers like bus drivers, social service providers, and hospital workers. True fiscal responsibility also means investing in prevention: education, healthcare, and services that help people build their lives.

 

RECLAIMING HOPE

It’s time to reclaim the public sector as the sphere of our shared interest. Rather than thinking in terms of the old paradigm that counterpoises “government” and “the market,” let us envision a new citizen movement to create a more participatory, democratic, and accountable system of self-government.

The San Francisco Community Congress is about bringing people together — community activists, those working in the trenches of our increasingly strained social services, our environmental visionaries, our artists, the urban gardeners and permaculturists, poets, bicycle enthusiasts, inventors … in short, assembling our pool of collective knowledge and wisdom, and yes, our differences — in a forum to discuss, debate, share concerns and viewpoints, and ultimately produce a working template that is both visionary and can be implemented.

The Community Congress will create a space for all of us to participate in defining our own vision of San Francisco. It is a first step toward reasserting popular control over economic development. It is an invitation to be visionary, rethinking in fundamental ways what it means to live in the 21st century city, and a forum for creating real, practical platforms and proposals that can be implemented using the powers of local government.

We want to propose a new vision of urban governance. Not more bureaucracy, more commissions, more departments, but the creation of new institutions that are democratically accountable and place new kinds of economic and political resources in the hands of ordinary citizens.

We don’t have any illusions. There are limits to what local government can do. Ultimately, deep change will require actions by higher levels of government. More profoundly, it will require a deeper change in citizen awareness, a rejection of life dominated by the pursuit of narrow self-interest, in favor of a more ecologically sustainable, socially just, and more democratic way of life.

But we can begin at the local level, here and now, to envision and implement the kind of changes that will need to take place if we want to insure that our city, our country, and our planet will be the kind of place we want our children to live. Please come. Bring your hopes, passions, and ideas. This is our collective project, our shared wisdom, our joint vision of the kind of city and society in which we want to live.

SHAREN HEWITT


“The thing I love most in life is being a grandmother for social change.”

“If you mess up, you fess up — and then you fix it up.” That’s one of the motivational philosophies Sharen Hewitt, founder and executive director of the Community Leadership Academy and Emergency Response Project (CLAER) passes on to the people she works with. Her organization provides peer-to-peer empowerment and civic engagement programs as well as immediate crisis stabilization for victims of violence, helping them get the support they need. CLAER is based in Bayview, “but we serve the whole city, which unfortunately needs us more than ever,” she says.

A community leader and organizer for decades, Hewitt has been a critical and unyielding voice on housing, voter registration, education, employment, and political access issues. Her current focus has been on easing recent tensions between the African American and Asian American communities, weeding through the crowded field of candidates running for District 10 supervisor, and “insuring continuing dialogue about the development of sound public policy in the face of diminishing resources.”

“We celebrate diversity, and we try to raise the bar every day,” she says of CLAER. “San Francisco is the richest city in the richest state in the richest country in the world. It should be unlimited in its capacity to serve.”

ISO RABINS

“My favorite thing about the Bay Area is the coast along Route 1. It consistently amazes me.”

Food revolutionary Iso Rabins has organized the most intriguing — and fun — food events of the last year, expanding his health code-defying Underground Market far beyond its original berth in a Mission District home. But his keystone contribution to the Bay Area is his ability to communicate his vision of feeding communities without the agro-industrial machine — by recognizing the soil-generated bounty available to all of us if we know where to look.

“The way our society is structured right now didn’t seem like it paid attention to our local community. I think food is a great way to break through that,” Rabins says. His brainchild is forageSF, an organization that promotes hunting and gathering through wild food walks, eight-course foraged meals, and retail opportunities for foragers who spend days picking through the woods, fields, and coastlines. In the locavore-freegan vein, Rabins calls attention to a world beyond shrink-wrap and leaden government regulations. And his message is being eaten up by change-hungry SF. “I really think you can do business and help people at the same time,” he says.

KATHERINE PRIORE

“Something I love about San Francisco is being able to take yoga classes with the best teachers from here to Timbuktu.”

Eleven years ago Katherine Priore was an English teacher in Cincinnati’s public school system. After a particularly stressful day in the classroom, she finally took a close friend’s advice by attending said friend’s yoga class. Priore was instantly hooked. “I had never experienced such profound internal stillness. My stress was alleviated and the stream of anxious, teaching-related thoughts vanished in those 90 minutes.” It was this eureka moment that set Priore on the path to creating Headstand, an organization providing youth in economically disadvantaged areas with access to yoga.

The organization’s ultimate goal is to create a shift in the education system whereby the physical, emotional, and psychological health of students has the same importance as the academic skills they’re building. Headstand aims to do its part by integrating yoga into the curriculum, not just as an elective but as a requirement. Over the past two years, the organization has offered 1,400 yoga classes to 660 youths in the East Bay and San Francisco, and this fall it plans to bring Headstand to San Jose and Houston. With a slew of evidence that Headstand is positively affecting the lives of its students, all signs point to the early success of the program and to the potential it may just be starting to fulfill.

ERICA MCMATH SHEPPARD

“I love the Youth Speaks office. It doesn’t matter what I’m wearing or what I look like there.”

Odds were against Erica McMath Sheppard to be onstage at the Warfield this past March receiving thunderous applause from a sold-out crowd. But as McMath Sheppard’s powerful championship Youth Speaks Teen Poetry Slam spoken word performance put it, “I been helping myself my whole damn life .” Two things were clear under those bright lights: this woman has a story to tell, and the world’s going to hear it — no matter a difficult childhood, a disastrous trek through the foster care system, and eventual emancipation from her guardians at age 16.

In addition to her poetry laurels and longtime involvement with the Youth Speaks arts program, the Class of ’10 Leadership High graduate was senior class president, involved in the Black Student Union, and active in a slew of other extracurriculars — a record that earned her admission to Dillard University in New Orleans this fall. Does she consider herself a role model? “I’m not trying to be the voice for foster girls around the world,” she says. “But this is my dream.”

DONNA SACHET


“It’s not always easy to live in San Francisco — but it sure is a hell of a lot of fun.”

A constant presence on the queer and charitable scenes for years, Donna Sachet will go to any lengths to call attention to worthy causes — including rappelling down 38 stories of the Grand Hyatt San Francisco to raise money for the Special Olympics.

As a performer and sparkling personality, Sachet MCs the popular Sunday’s a Drag weekly brunch spectacular at Harry Denton’s Starlight Room, hosts the live coverage of the Pride parade on television, writes a society column for The Bay Area Reporter, and attends pretty much every charitable event worth attending. (You can always spot her by her impeccably tailored red outfits — she is, after all, Scarlet Empress XXX of San Francisco’s Imperial Court.) Her annual holiday Songs of the Season event and Pride Brunch fundraiser, along with her involvement with the Bare Chest Calendar benefiting the AIDS Emergency Fund, have raised thousands of needed dollars.

“You just have to do it,” she tells us of her unflagging energy. “I love my community. But even if it’s not particularly about your own community, we’re all in this together.”

VERNON DAVIS

“When I paint, I focus completely on what I’m doing and everything else fades.”

Freshly minted Pro Bowl superstar Vernon Davis has shown immense prowess on the football field since being drafted by the San Francisco 49ers in 2006. His career is on the upswing, and last season he tied the NFL all-time record for most touchdowns as a tight end. Davis’ success is the product of natural talent combined with drive and vision. He grew up in inner-city Washington, D.C., where a wise grandmother helped him dodge the environment’s potential pitfalls.

That same talent, drive, and vision extend beyond the goal posts into more esoteric realms. He’s an avid painter and seeks to be a role model for kids who might be afraid to explore their creativity. Earlier this year he launched the Vernon Davis Scholarship Fund, which will benefit a deserving Bay Area art student who would otherwise not be able to afford college. “I want to keep encouraging kids, especially in the inner city, to stay on track and pursue their dreams.”

JANE MARTIN


“I love being around a really vibrant queer and progressive community.”

On March 8, labor activist Jane Martin helped organize a flash mob in the crowded lobby of San Francisco’s Westin St. Francis Hotel. The purpose was to spread the word about a worker-called boycott of the hotel and urge tourists coming in for Pride to stay elsewhere. For five raucous and entertaining minutes, members of Pride at Work/HAVOQ, One Struggle One Fight, and the Brass Liberation Orchestra burst through the doors to sing, play, and dance to Lady Gaga’s hit “Bad Romance,” warning bewildered patrons not to “get caught in a bad hotel.”

The result: A collaborative effort of young and innovative labor leaders like Martin became a viral YouTube sensation, reaching hundreds of thousands of viewers. Martin has been joining with hotel workers in picket lines and organizing around queer economic justice issues in the Bay Area since 2001. She led picket lines at the Omni Hotel to decry the company’s move of locking out thousands of workers. “To ultimately win was really exciting,” she said. “When the hotels backed off, that was really inspiring.”

She recently joined 1,000 in staging a protest at the home of GOP gubernatorial candidate Meg Whitman as part of her organizing work with the California Nurses Association. And, as always with Martin, there’s more in the works.

“The Bay Area embodies the American spirit more than anyplace else in the country. You can be who you are without any fear.”

San Francisco is a city of immigrants, a place where generations of people have come — from all over the country and all over the world — for a fresh start in a welcoming environment. But Mayor Gavin Newsom put that tradition at risk this year when he directed law enforcement agents to start referring juveniles charged with crimes to federal immigration authorities. It’s been a disaster — in one case, a 13-year-old charged with stealing 46 cents was turned over to the feds, and he and his mom, who is married to a U.S. citizen, both faced deportation, breaking up a family.

San Francisco Sup. David Campos has led the battle to protect the city’s sanctuary policy — and has taken on the larger issue of immigration reform. An immigrant who arrived in the United States from Guatemala at 14 (and who couldn’t get federal financial aid to go to college because of his status), Campos isn’t afraid to challenge the growing nativist movement: “What’s made this country great,” he told us, “is taking talent from all over the world and integrating it into society. Now the current climate precludes that.”

Why is Pelosi killing ENDA?

OPINION Why is the Congressmember from the gayest city in America blocking legislation that protects lesbian, gay, bisexual, and transgender workers from workplace discrimination? That’s the question LGBT workers across the country are asking, and why LGBT workers picketed her office in the Federal Building and delivered a letter demanding that she not kill the Employee Non-Discrimination Act (ENDA).

Most LGBT workers have no protections from workplace discrimination. ENDA would provide legal protection against discrimination nationally. In 29 states, it is still legal to fire someone solely because they are lesbian, gay, or bisexual. And in 38 states it is legal to fire someone solely for being transgender. The current version of the bill would outlaw discrimination on both sexual orientation and gender identity.

Speaker of the House Nancy Pelosi repeatedly promised that she would schedule a vote on the law, but repeatedly broke these promises.

A 2006 study by the Guardian and Transgender Law Center found that 60 percent of transgender people in San Francisco earn less than $15,300 per year, only 25 percent have a full-time job, and nearly 9 percent have no source of income.

Only 4 percent reported making more than $61,200, which is about the median income in the Bay Area. More than half of local transgender people live in poverty, and 96 percent earn less than the median income. Forty percent of those surveyed don’t even have a bank account.

What this study reveals is that even in a city that is considered a haven for the LGBT community, transgender workers face profound employment challenges and discrimination. If this is true in San Francisco, imagine the figures in less queer-friendly towns.

A 2007 meta-analysis from the Williams Institute of 50 studies of workplace discrimination against LGBT people found consistent evidence of bias in the workplace. The analysis found that up to 68 percent of LGBT people reported experiencing employment discrimination, and up to 17 percent said they had been fired or denied employment.

Public opinion polling shows that Americans are overwhelmingly in favor of making sure LGBT Americans get the same employment opportunities as everyone else. In fact, the latest surveys show that nearly 90 percent of Americans support workplace fairness for LGBT workers.

In a few weeks, Congress will finish its legislative business for the year so members can return to their districts to run for reelection. Last month at a LGBT Pride event, Rep. Jackie Spier (D-San Mateo) announced to a stunned crowd that not only would we not get ENDA before the end of the legislative session but she doesn’t think we would get it for five years because we won’t have enough votes in Congress again to ensure passage.

That’s right, at this moment, members of Congress are planning on leaving town and going home to campaign for their own jobs — while leaving thousands of LGBT workers without protections for the next five years. When 90 percent of Americans support workplace fairness, it’s challenging to believe that Pelosi fears a backlash from the voters.

That said, it’s fair to say that Pelosi may get a backlash from LGBT voters if she continues to block ENDA from a vote. The time to pass ENDA is now. The American people support it; the politicians promised it. No more broken promises. We demand that the House speaker stop blocking ENDA and schedule a vote.

Lennar Corp.’s massive redevelopment plan for Candlestick Point-Hunters Point cleared a critical hurdle July 14 when the Board of Supervisors voted 8-3 to affirm the Planning Commission’s certification of the project’s final environmental impact report, with Sups. John Avalos, Chris Daly, and Eric Mar opposed

Board President David Chiu called the vote "a milestone." Termed-out Sup. Sophie Maxwell, whose District 10 includes Candlestick Point and the former Hunters Point Naval Shipyard, saw the vote as evidence that city leaders support the ambitious plan. Yet many political observers saw the vote as proof that Lennar and its Labor Council allies have succeeded in lobbying supervisors not to support opponents of the project.

"I’m concentrating on pushing this over the finish line," Maxwell said at the hearing in the wake of the vote, which came in the wee hours of July 14 after a 10-hour hearing. Supervisors can still amend Lennar’s development plan during a July 27 hearing and project opponents are hoping for significant changes.

Mar said he wants to focus on guaranteeing that the city has the authority to hold Lennar responsible for its promises. "I want to make sure that we have the strongest enforcement we can," he said.

Lennar’s plan continues to face stiff opposition from the Sierra Club, the Golden Gate Audubon Society, the California Native Plant Society, San Francisco Tomorrow, POWER (People Organized To Win Employment Rights) and CARE (Californians for Renewable Energy).

Representatives for these groups, whose appeals of the EIR certification were denied by the board, say they are now weighing their options. Those include taking legal action within 30 days of the board’s second reading of and final action on the developer’s final redevelopment plan, which will be Aug. 3 at the earliest.

Supervisors are expected to introduce a slew of amendments July 27, when they consider the details of the proposal and its impacts on the economically depressed and environmentally polluted.

Michael Cohen, Mayor Gavin Newsom’s top economic advisor, admitted July 19 that all these various demands will likely delay project construction. "But 702 acres of waterfront land in San Francisco is an irreplaceable asset," Cohen reportedly told the San Francisco Chronicle. "It’s not a question of if — but when — it gets developed."

Chiu already has introduced five amendments to the plan in an effort to alleviate concerns about shipyard toxins, Lennar’s limited financial liability, a proposed bridge over Yosemite Slough, and the possibility that local residents will need more access to healthcare and training if they are to truly benefit from the development plan.

Sup. Ross Mirkarimi told the Guardian that he expects the board will require liquidated damages to ensure the city has some redress if the developer fails to deliver on a historic community benefits agreement that labor groups signed when Lennar was trying to shore up community support for Proposition G, the conceptual project plan voters approved in June 2008.

Mirkarimi said the board would also seek to increase workforce development benefits. "Thirty percent of the target workforce population are ex offenders. So while they might get training, currently they won’t get jobs other than construction," Mirkarimi observed.

He supports the health care access amendment and the public power amendment Chiu introduced July 21, pointing to Mirkarimi’s previous ordinance laying the groundwork for public power in the area. "This ordinance established that where feasible, the City shall be the electricity provider for new City developments, including military bases and development projects," Mirkarimi said. "PG&E was ripped when we pushed that through."

But Sierra Club activist Arthur Feinstein isn’t sure if additional amendments will help, given intense lobbying by city officials and a developer intent on winning project approvals this summer before a new board and mayor are elected this fall.

"Chiu’s amendments gave us what we asked for over Parcel E-2" Feinstein said, referring to a severely contaminated section of the shipyard for which Chiu wants an amendment calling for a board hearing on whether it’s clean enough to be accepted by the city and developed on.

But Feinstein is less than happy with Chiu’s Yosemite Slough amendment, which would limit a proposed bridge over it to a width of 41 feet and only allow bike, pedestrian, and transit use unless the 49ers elect to build a new stadium on the shipyard. In that case, the project would include a wider bridge to accommodate game-day traffic.

"The average lane size is 14 feet, so that’s a three-lane bridge. So it’s still pretty big. And it would end up filling almost an acre of the bay," Feinstein said.

Feinstein thanked Mirkarimi and Campos for asking questions that showed that the argument for the bridge has not been made. "But it’s disappointing that a progressive Board would be willing to fill the Bay for no reason," Feinstein said.

He concurred with the testimony of Louisiana-based environmental scientist Wilma Subra and environmental and human rights activist Monique Harden, who challenged the wisdom of the Navy digging out toxins while the developer installs infrastructure at the same site.

Subra said contamination is often found at Superfund sites after they have been declared clean when contractors to later dig into capped sites and expose workers and the community to contamination. Harden said the plan to begin construction on some shipyard parcels while the Navy removes radiological-contamination from shipyard sewers is "like a person jumping up and down on a bed that another person is trying to make."

But Cohen, who has aggressively pushed the project on Newsom’s behalf, countered that there is no scientific evidence to support such concerns. "It’s a very common situation," Cohen said. "It’s the basis for shipyard artists and the police being on the site for many years … It’s safe based on an extraordinary amount of data."

But Feinstein pointed to his experience working for the Golden Gate Audubon Society at the former Alameda Naval Station. He recalls how a remediation study was completed, but then an oil spill occurred at the site, which had been designated as a wildlife refuge.

"The military didn’t know about everything that happened and was stored on site, and it’s easy to miss a hot spot," he said. "And who’ll be monitoring when all these homes are built with deeds that restrict the renters and owners from digging in their backyards?"

Feinstein said he’s concerned that only Campos seemed to be asking questions and making specific requests for information around the proposed project’s financing

"Lennar is paying city staff and consultants and promising labor huge numbers of jobs. When you are throwing that much money around, it’s hard for people to resist — and the city has been co-opted," Feinstein said. "And how much analysis and resistance can you expect from city commissions when the Mayor’s Office is the driving force behind the project? So we don’t have a stringent review. The weakness of the strategy of ignoring our bridge concerns is that when we sue, we may raise a whole bunch of issues."

Arc Ecology director Saul Bloom says Chiu’s bridge proposal "screwed up the dialogue. We were close to a deal," Bloom claims. "But while that amendment allowed one board member to showboat, it prevented the problem from being solved."

Bloom is concerned that under the financing deal, the project won’t make any money for at least 15 years and will be vulnerable to penalties and bumps in the market — an equation that could lead the developer to build only market rate housing at the site.

"It’s a problematic analysis at best," he said.

"The bigger the development, the more it benefits people who have the capacity to address it — and that’s not the community," Bloom said. "So there’ll be more discussion of the bridge, and that’s where the horse-trading is going to be."

He also said the bridge has now taken on a symbolic value. "The thing about the bridge is that it’s not actually about the bridge any more," Bloom added. "It’s about Lennar telling people, ‘You will support us.’ If they get the bridge, it will give them free rein, an unencumbered capacity to do as they see fit. They are willing to make deals, but they have to have the bridge because it defeats the people who have been the most credible and visible — and then they have no opposition."

Congress is acting stupidly

AFL-CIO President Rich Trumka has it right. It’s not the heat in Washington, D.C., that’s bothering him and many other advocates of working people. It’s the stupidity – the economic stupidity of Congress refusing to give financial aid to states that badly need help in order t o save the jobs of some 300,000 teachers, nurses, firefighters, police and other public service workers who are facing layoffs because of budget deficits.

The possible remedy is at hand – a pending $100 billion jobs bill.  Most of the money would go to states for quickly creating or saving up to one million jobs in public and private employment, restoring government services that have been cut, and averting other planned cuts, mostly in education, public safety and job training.

Republican opposition has kept the jobs bill from passage. The GOP also opposes a companion bill that deals with another bit of economic stupidity in Washington – the stupidity of Congress’ refusal to extend the unemployment insurance benefits of the 1.4 million Americans who will run out of benefits by the end of July, and the 325,000 who already have run out of benefits.

By year’s end, more than eight million workers will have exhausted their benefits. Their regular benefits, averaging $300 a week, ran out after 26 weeks and have not been extended as they usually have been during periods of heavy unemployment. The House voted for extension, and President Obama urged extension. But the Senate has refused to act.

The AFL-CIO’s Trumka calls the situation tragic, as well he should. He notes that almost 15 million Americans are currently unemployed, a number that’s been growing by about 250,000 workers per week.

So, 15 million people who need jobs – many who desperately need jobs – are unable to find them. About one million have been jobless for more than a year.

Overall, the jobless make up about 10 percent of the workforce. They’ve been out of work an average of 35 weeks. Another 11 million Americans are underemployed, including temporary and part-time workers and others who are underutilized and underpaid.

Nearly half of all the jobless have been out of work for more than six months.  As Trumka says, “Families are stretched to the limit and state budgets are under incredible strain, putting hundreds of thousands more jobs in danger. Yet the Republicans in Congress repeatedly have blocked efforts to take action, create jobs and rebuild our battered economy.” Although it’s mainly Republicans who’ve opposed extension of benefits, some conservative Democrats have also opposed extension.

Trumka, noting that many politicians, including every member of the House, will be on the ballot in the coming mid-term elections, urges union members to demand that the office seekers take concrete action to “rebuild our economy and create jobs now.” If they don’t take action, Trumka warns, “they may not be elected officials anymore.”

New York Times’ columnist Paul Krugman blames Congress’ failure to provide relief to the jobless on “a coalition of the heartless, the clueless and the confused.”

Krugman defines the heartless as “Republicans who have made the cynical calculation that blocking anything President Obama tries to do – especially anything that  might ease the country’s economic problems – improves their chances in the midterm elections.

And the clueless? Try Sharron Angle, the Republican candidate for senator from Nevada. She’s repeatedly claimed that the unemployed are deliberately choosing to stay jobless so they can keep collecting the benefits of a few hundred dollars a week.

The confused include politicians and others who apparently are too confused to understand the obvious – that the unemployed need money, and will quickly spend whatever they get in the way of extended benefits, thus boosting consumer spending, helping create jobs quickly and otherwise expanding the economy.

Except to the heartless, clueless and confused, saving money at the expense of the unemployed by denying them benefits is, as Paul Krugman says, “cruel as well as misguided.”

Board votes on Candlestick-Shipyard project EIR appeal today

The Chronicle’s suggestion that the city’s massive Candlestick-shipyard project may be facing smoother sailing seems like wishful thinking to those who attended a July 12 noontime rally that was organized by POWER (People Organized to Win Employment Rights) and featured two Louisiana-based advocates who protested the project’s EIR and shared many of the longstanding concerns about project cleanup, infrastructure and financing.

The Chronicle was of course referring to five amendments to the city’s massive redevelopment proposal that Board President David Chiu introduced during yesterday’s July 12 meeting of the Board’s Land Use committee. The Chron interpreted these amendments as a sign that Chiu plans to approve the project’s environmental impact report, which comes before the Board today, after several groups appealed the final EIR that the Planning Commission approved last month.

But while city officials fear the developer will walk, if the Board does not approve the final EIR, some environmental advocates hope a better plan could be reached.

At POWER’s July 12 rally, nationally acclaimed environmental scientist Wilma Subra called on the District Attorney’s environmental justice department to “step up.” Subra claimed that the project’s final EIR “failed to evaluate and assess the cumulative impacts of exposure to children, adults and the environment as a result of exposure to all of the chemicals at the site.”

Monique Harden, co-director and attorney for Advocates for Environmental Health Rights (AEHR) of New Orleans, Louisiana, pointed to “deep flaws in the environmental regulation system,” as a reason why low-income communities of color should be concerned about the proposed plan.
“Why in the middle of an environmental crisis caused by BP in the Gulf am I coming to San Francisco?” Harden asked. “Because San Francisco is providing unequal environmental protection to its residents. As a resident of New Orleans, I’m concerned that San Francisco is careening towards making a decision that can crush the future of Bayview Hunters Point,”

But as local Bayview resident Jose Luis Pavon began talking about seeing gentrification occur in his lifetime within San Francisco, he and others got shouted down by a group of yellow and green-shirted project supporters, who were led by a guy calling himself Bradley Bradley and Alice Griffith public housing resident Stormy Henry.
“This is the devil’s trick in the last hour,” Henry said of the POWER rally.

Henry shared her heartfelt belief that if the Board approves the project’s final EIR, she and other Alice Griffith residents will get desperately needed new housing units. even if it takes some years to build them. Others in her group were unable to answer media questions: they had difficulty speaking in English, but were clutching neatly written statements in support of the project that they later read aloud at the Board’s Land Use Committee hearing.

As these project supporters prepared to move inside to attend the Land Use Committee meeting and lobby supervisors for their suppor, D. 10 candidate Tony Kelly shared his concerns that the Navy has a demonstrated history of finding nasty things at the shipyard years after they say everything’s clean, and that this pattern could jeopardize the plan.

“This happened at Parcel A,” Kelly said, referring to the first and only parcel of land that the Navy transferred to the city for development in 2004. “Since then, Parcel A has gotten smaller and as they found stuff on sites they then renamed as new parcels, like UC-3, which has radiological contamination in a sewer line that goes into the Bayview. So, that means the contamination is now in the Bayview.”

Kelly is concerned that the city is trying push through EIR certification before the Navy completes an environmental impact statement (EIS) related to shipyard cleanup activities. “The EIS is supposed to go before the EIR, as far as I know,” Kelly said

At the Land Use Committee meeting, Sup. Sophie Maxwell, whose district includes Candlestick and the Shipyard,said, the project was about “revitalization and opportunity.”

She noted that the certification of the project’s final EIR has been appealed to full Board’s July 13 meeting. She further noted that she intends to introduce legislation next week to address concerns that Ohlone groups have expressed.

The next two hours were full of testimony from a bevy of city officials, beginning with Michael Cohen, Mayor Gavin Newsom’s top economic advisor in the Office of Workforce and Economic Development.

“Every single element [of this project] has been discussed and debated at countless meetings,” Cohen claimed, as he sought to quell fears that the community had not been properly consulted with over the plan. “As we get closer to a vote, all of a sudden pieces of paper start circulating, criticizing project and suggesting that community involvement just began,” he continued. ” That’s factually untrue.”

He also sought to reassure the supervisors that the Board will have a say-so as to whether the city accepts early transfer of shipyard parcels from the Navy.
“Neither the city nor the developer have any specific authority over the cleanup,” Cohen said, noting that the cleanup is governed by specific rules set out in CERCLA [Comprehensice Environmental Response, Compensation and Liability Act, aka Superfund].

“Regardless of what we do, CERCLA will continue to be the regulatory tool,” Cohen said. ” I urge you not to be confused by CEQA and CERCLA.”

So, how can the city implement Prop. P, which voters overwhelmingly supported in 2000, urging the Navy to clean up the shipyard to highest attainable standards.
“Prior to any transfer, US EPA and DTSR have to concur in writing that the shipyard is safe,” Cohen explained, noting that, thanks to Speaker of the House Nancy Pelosi, the Navy has already spent over $700 million on shipyard cleanup efforts.

“We have 250 artists at the shipyard….but not a shred of scientific evidence to say that the shipyard is not safe,” Cohen claimed. “It’s safe to develop the shipyard in precisely the manner we are proposing.”

When Sup. Eric Mar raised the question of radiological contamination on Parcel UC-3, Cohen downplayed Mar’s concerns.
“The exposure levels are lower than watching TV,” Cohen claimed. “The primary source is very low level radiation from glow-in-the-dark dials.”
Indicating a map that showed a network of old sewers (in blue) and old fuel lines (in red) under the entire development area, Cohen said, “The radiological contamination that has and will be addressed at the shipyard is quite low level. You have radiation, you get nervous. We asked EPA to come out and do a scan to deal with the issue.”

IBI Group’s David Thom, the lead architect and planner for the project said the plan is designed “to connect new development back into the Bayview.”
“And this plan connects the Bayview through to the water.”

Tiffany Bohee, Cohen’s deputy in the Mayor’s Office of Economic and Workforce Development, insisted that project’s proposed bridge is better than Arc Ecology’s proposed alternative route, which would not involve constructing a bridge over an environmentally sensitive slough.
“The non-bridge route increases the number of intersections,” Bohee said, seeking to turn an environmental question (the impact of bridge on wildlife and nature experience) into a public safety issue.”
She claimed the BRT route over bridge was 5-10 minutes faster than Arc’s proposed alternative, “because there are fewer turns, it can go at higher speeds.” But Arc’s studies suggest the BRT route over the bridge is only a minute faster, and would cost over $100 million.

Bohee noted that $50 million from the sale of 23 acres of parkland for condos at the Candlestick Point State Recreation Area (CPSRA) will be “set aside for the state, and won’t be able to be raided by the city,” with $40 million going to improvements, and $10 million to ongoing operation and maintenance costs.

She also cited additional benefits that the project would bring to the community, including thousands of construction job opportunities.

“We are working with City Build to make sure they are for local residents,” Bohee said.“And there is absolutely no displacement for the rebuild,” Bohee continued referring to proposal to place current Alice Griffith public housing iresidents n new units, on a 1-1 basis

Eric Mar said he was impressed by many elements of the plan, but continued to express reservations.
“I’m still concerned that is seems to serve newcomers as proposed to existing residents,” he said. “And I’m still not convinced that the bridge is the best for existing residents.”

Rhonda Simmons, who works in Cohen’s Office of Economic and Workforce Development,  tried to flesh out details of the project’s job creation promises.
“The most immediate workforce is related to the construction site, and as you know, this project goes over a 15-20 year span,” Simmons said, pointing to green tech and retail as job opportunities that will exist once the project is built.

Mar expressed concern that the jobs may not be at the level of D.10 residents
“How is this gonna bring their skill level up?” he asked.
“The idea is that training gives first level entry at a variety of building trades,” Simmons said, pointing to the project’s large solar component.

“What about women?” Sup. Maxwell asked
Simmons pointed to retail opportunities,
“The idea of the training is to give folks job readiness skills, like getting there and showing up on time,” she said

Mar wanted to know who would have oversight of monitoring and compliance.
“In the city we have a tapestry of folks who do contract compliance,” she said. “The oversight will come from a variety of places.”

After Kurt Fuchs of the Controller’s Office listed the estimated economic benefits of the project, Board President David Chiu observed that the city is “at a crossroads.”

“I do not plan to prejudge,” Chiu continued, as he introduced his five amendments to regulate the Parcel E-2 cleanup, the size of a proposed bridge over the Yosemite Slough, expand healthcare access in the Bayview, create a workforce development fund and lay the groundwork for bringing public power to the project.

During public comment, Bayview resident Fred Naranjo pleaded for project support.  

“Please don’t let the train leave the station,” Naranjo said. “If Lennar leaves, the Bayview will never be developed.”

And Tim Paulson, executive director of the San Francisco Labor Council expressed hope that an agreement was getting closer.
“There really is a path to getting this done,” Paulson said. “This really is a model project in many ways for the rest of the United States.”
But D. 10 resident Linda Shaffer with the Yerba Buena chapter of the California Native Plant society indicated the huge pressure exerted on folks to support the project
“I do not want to be classified as an opponent, but we have concerns,” Shaffer said, noting that her group has filed an appeal of the project’s final EIR.

And while the Sierra Club’s Arthur Feinstein thanked Chiu for proposing to reduce the size of the bridge, he pointed out that Chiu’s amendment wasn’t really a compromise.
“That’s because it’s still a bridge,” Feinstein said, as he explained how noisy the area surrounding the slough will become as traffic whizzes by.

Connie Ford of the Labor Council accused some project critics of being “disrespectful.”
Ford took particular issue with claims that the project will gentrify the area
“The neighborhood is changing,” she said. “Since 1990, African American families have been leaving the Bayview in huge numbers. I encourage you to see this project as a good plan.”

Gabe Metcalfe of SPUR expressed his unconditional support for the plan,
“This plan is being asked to fix a huge number of problems,” he said.
Noting that the bridge continues to be a sticking point, Metcalfe said he sees opposition to every transportation project these days.
“We seem to be in a moment when you can’t build anything without it being opposed.”

But other speakers from the Sierra Club reiterated their stance that there are better and viable options to the bridge, noting that it is too costly, and that the surrounding community and wildlife would be better off without it.”

All these competing viewpoints suggest that whatever decision the Board makes today, it will take some time and create plenty of uproar. So, here’s hoping the Board votes in a way that will truly benefit the D. 10 community, not career politicians, city officials and out-of-state developers. It’s about time.

Taming finance in an age of austerity

NEW YORK – It was not long ago that we could say, “We are all Keynesians now.” The financial sector and its free-market ideology had brought the world to the brink of ruin. Markets clearly were not self-correcting. Deregulation had proven to be a dismal failure.

The “innovations” unleashed by modern finance did not lead to higher long-term efficiency, faster growth, or more prosperity for all. Instead, they were designed to circumvent accounting standards and to evade and avoid taxes that are required to finance the public investments in infrastructure and technology – like the Internet – that underlie real growth, not the phantom growth promoted by the financial sector.

The financial sector pontificated not only about how to create a dynamic economy, but also about what to do in the event of a recession (which, according to their ideology, could be caused only by a failure of government, not of markets). Whenever an economy enters recession, revenues fall, and expenditures – say, for unemployment benefits – increase. So deficits grow.

Financial-sector deficit hawks said that governments should focus on eliminating deficits, preferably by cutting back on expenditures. The reduced deficits would restore confidence, which would restore investment – and thus growth. But, as plausible as this line of reasoning may sound, the historical evidence repeatedly refutes it.

When US President Herbert Hoover tried that recipe, it helped transform the 1929 stock-market crash into the Great Depression. When the International Monetary Fund tried the same formula in East Asia in 1997, downturns became recessions, and recessions became depressions.

The reasoning behind such episodes is based on a flawed analogy. A household that owes more money than it can easily repay needs to cut back on spending. But when a government does that, output and incomes decline, unemployment increases, and the ability to repay may actually decrease. What is true for a family is not true for a country.

More sophisticated advocates warn that government spending will drive up interest rates, thus “crowding out” private investment. When the economy is at full employment, this is a legitimate concern. But not now: given extraordinarily low long-term interest rates, no serious economist raises the “crowding out” issue nowadays.

In Europe, especially Germany, and in some quarters in the US, as government deficits and debt grow, so, too, do calls for increased austerity. If heeded, as appears to be the case in many countries, the results will be disastrous, especially given the fragility of the recovery. Growth will slow, with Europe and/or America possibly even slipping back into recession.

Stimulus spending, the deficit hawks’ favorite bogeyman, did not cause most of the increased deficits and debt, which are the result of “automatic stabilizers” – the tax cuts and spending increases that automatically accompany economic fluctuations. So, as austerity undermines growth, debt reduction will be marginal at best.

Keynesian economics worked: if not for stimulus measures and automatic stabilizers, the recession would have been far deeper and longer, and unemployment much higher. This does not mean that we should ignore the level of debt. But what matters is long-term debt.

There is a simple Keynesian recipe: First, shift spending away from unproductive uses – such as wars in Afghanistan and Iraq, or unconditional bank bailouts that do not revive lending – toward high-return investments. Second, encourage spending and promote equity and efficiency by raising taxes on corporations that don’t reinvest, for example, and lowering them on those that do, or by raising taxes on speculative capital gains (say, in real estate) and on carbon- and pollution-intensive energy, while cutting taxes for lower-income payers.

There are other measures that might help. For example, governments should help banks that lend to small- and medium-size enterprises, which are the main source of job creation – or establish new financial institutions that would do so – rather than supporting big banks that make their money from derivatives and abusive credit card practices.

Financial markets have worked hard to create a system that enforces their views: with free and open capital markets, a small country can be flooded with funds one moment, only to be charged high interest rates – or cut off completely – soon thereafter. In such circumstances, small countries seemingly have no choice: financial markets’ diktat on austerity, lest they be punished by withdrawal of financing.

But financial markets are a harsh and fickle taskmaster. The day after Spain announced its austerity package, its bonds were downgraded. The problem was not a lack of confidence that the Spanish government would fulfill its promises, but too much confidence that it would, and that this would reduce growth and increase unemployment from its already intolerable level of 20%. In short, having gotten the world into its current economic mess, financial markets are now saying to countries like Greece and Spain: damned if you don’t cut back on spending, but damned if you do as well.

Finance is a means to an end, not an end in itself. It is supposed to serve the interests of the rest of society, not the other way around. Taming financial markets will not be easy, but it can and must be done, through a combination of taxation and regulation – and, if necessary, government stepping in to fill some of the breaches (as it already does in the case of lending to small- and medium-size enterprises.)

Unsurprisingly, financial markets do not want to be tamed. They like the way things have been working, and why shouldn’t they? In countries with corrupt and imperfect democracies, they have the wherewithal to resist change. Fortunately, citizens in Europe and America have lost patience. The process of tempering and taming has begun. But there is far more yet to do.

A new New Deal for San Francisco

OPINION On Thursday and Friday, July 8 and 9, San Franciscans concerned about the future of their city will have a unique opportunity to devise practical, locally actionable proposals to shape and direct future policy affecting the local economy and the provision of critical human services.

On July 8, starting at 3:30 p.m. at SF Lighthouse Church (1337 Sutter at Van Ness), a New Deal for the City economic development summit will be held to address set of issues ranging from municipal reform to community-based economic development proposals. The next day, the San Francisco Human Services Network, a 110-member organization of human and health service nonprofits, will host its New Realities summit starting at 9 a.m. at the McClaren Center at the University of San Francisco. The results of these two summits, along with proposals on Muni reform and affordable housing, will form the basis for a citywide meeting of “The New, New Deal for San Francisco” Congress, scheduled for Aug. 14 and 15 at USF.

The summits and congress offer a chance to discuss, adopt, and plan the implementation of a comprehensive response to the assault on the provision of critical public services and the clear failure of the local economy to respond to the current and future needs of San Franciscans. Over the past decade, San Francisco has lost, and never replaced, more than 70,000 permanent jobs as first the dot-com bust and now the implosion of the financial sector have shredded the city’s “new” economy. In a total reversal of its historic role, San Francisco is no longer the employment center of the Bay Area, but simply the high-end bedroom of a commuting workforce based outside the city.

This historic shift has meant that the primary form of development in San Francisco has gone from commercial, employment-based enterprises to high-end residential development — development that, because of Proposition 13 limits on local property taxes, simply fails to pay for the city services needed to support the existing and new residential population.

San Franciscans built a system of local governance that was unique in the state, and not often matched in the nation, in providing a level of municipal services based on the premise that we share a special place and a common future. These services were provided by a robust mixture of traditional public sector departments and innovative, community-based nonprofits. That system was itself based on an economy that mainly employed San Francisco residents in a diverse mix of economic activities with opportunities open to a wide array of people.

That economic base has been reduced to a mere shell of its former diversity, with few opportunities for even fewer people. Our current mayor has no desire to address this historic shift; instead, he is content to endlessly campaign for other offices, issue press releases on mythical achievements, and pit one portion of San Francisco against another in hopes that all forget the decline of the city under his leadership.

Progressive forces cannot again allow needed changes to be held hostage to the election of a particular candidate. We must put on the table a comprehensive, integrated set of locally actionable policies that make sense in the realities we face in the second decade of the 21st century — no matter who wins. After all, it’s our city.

Political litmus test for Hunters Point Shipyard access?

Even though the U.S. Navy abandoned the Hunters Point Shipyard in 1974, the military has continued to control access to the shipyard that helped launch the A-Bomb. That’s because the Navy still owns most parcels of land on the shipyard and remains on the hook for cleaning up pollutants on these sites, including a radiologically impacted dump on Parcel E2, which has been deemed to be the dirtiest land on the site.

Currently, the Navy is proposing to cap, not excavate this landfill, despite repeated requests from the local community, and a citywide vote in support of Proposition P in 2000, which urged the Navy to clean up the land to the best extent possible, which would mean excavating the Parcel E2 landfill and replacing it with clean uncontaminated soil. And oddly, the City appears to want government agencies and officials to sign off on its final EIR for Lennar’s massive 770-acre redevelopment plan for the shipyard and Candlestick Point, even though the Navy has not yet completed an environmental impact statement (EIS) related to its proposed shipyard cleanup activities.

Currently, the Navy controls access to the facility beyond a couple of trailers that the city’s Redevelopment Agency has set up just within the yard’s main gate. And to gain access to the shipyard these days, you need to call or visit Redevelopment’s trailer and get a pass. Or, alternatively, if you know any of the artists who continue to rent studios at shipyard, you can call them to try and get the city to give you a pass.

Underlying these limits to accessing the shipyard are some legitimate safety concerns related to equipment and excavations on what is now an active clean up and construction site, along with fears that untoward characters could break into the abandoned buildings or bother the artists who still have studios in operation at the shipyard. But has an additional political litmus test been put in place when it comes to critics of Lennar’s redevelopment plan, who want to access to the yard? If so, does it mirror the tap dancing that the local community has had to undergo to get its voices heard as Lennar pushes to get final approval for its shipyard/ Candlestick Point redevelopment plan.

Those questions resurfaced last week when a private security guard manning the shipyard’s front gate denied access to D. 10 supervisor candidate DeWitt Lacy, who had dropped by hoping to take this reporter around the yard as part of an ongoing conversation about Parcel E2, which Lacy believes needs to be excavated completely, and how best to hold the Navy accountable for cleaning up a mess it created decades ago. The security guard told Lacy that folks who want to visit must get a pass at the Redevelopment Agency trailer.

At the Redevelopment trailer, Micah Fobbs, administrative assistant for W.B. Kennedy and Associates, which has a contract with Redevelopment’s Citizen’s Advisory Committee. told Lacy that without a preauthorized pass, he couldn’t let us onto the site. Fobbs added that he would be happy to take us on a tour himself, but he could not leave the trailer unmanned, since he was the only staff member there at the time. Fair enough. Though the rebuff gave us the feel that the City doesn’t want pesky investigative reporters that have been critical of the development running around the site. “And if they found out I was a civil rights attorney, they probably wouldn’t want me out here, either,” Lacy joked.

But the next day, I encountered what sounded like overt hostility to other critics of Lennar’s plan, when I tried to ride along on what had been billed as a “Toxic Tour of the Navy Shipyard” by POWER (People Organizing to Win Employment Rights). POWER had advertised its tour in an email which said it would involve 23 expert urban planners, who happened to be in the Bay Area for a Progressive Planning Forum. The tour was billed as happening on the morning of June 17, before an afternoon discussion at POWER’s Third Street office in the Bayview, which was to focus “on alternative approaches to the city’s current plan for development at the Shipyard/ Candlestick Point.”

Caught in traffic, I didn’t arrive at the Boys and Girls Club on Kiska Road in Bayview Hunters Point in time to join POWER’s kick-off get together. So, I headed direct to the shipyard, a move that meant I arrived alone and ahead of the school bus that POWER had rented for the occasion. At the gate, I was told by the security guard that I couldn’t get in, that another guard lost his job for letting unauthorized individuals onto the site, that POWER didn’t have a pass and that they’d been warned to watch for POWER “because they want to stop the development.”

“If you are not authorized with badges, you are not let through,” the guard said, giving me the telephone number of the Hunters Point Duty police officer, who in turn said I needed to call the San Francisco Redevelopment Agency, which in turn told me to call the folks at the Redevelopment Agency’s shipyard trailer. And so I called Fobbs again, who confirmed that the Navy still controls all the property, except Parcel A which has already been conveyed to the City which in turn has granted developer Lennar the right to develop thousands of condos on that particular parcel.

“As far as viewing the rest of the property, you have to put in a request, and no photography or videography is allowed,” Fobbs said. This stated ban on photography came as a surprise, given recent photos of the shipyard that ran in a New York Times article about Lennar and the city’s vision for the 770-acre property.

And the sudden difficulties in gaining media access seemed odd, given that Lennar’s PR firm, Sitrick and Company, offered to take the media on a tour on the morning of June 3—the day the Redevelopment and Planning Commissions subsequently approved the final EIR for Lennar’s plan to redevelop the rest of the shipyard, plus Candlestick Point, a FEIR that has now been appealed to the Board, on the grounds that it was rushed for political reasons, leading to fatal flaws in the final document.

“Well, if folks come here through Redevelopment or the Mayor’s Office, then they have been able to take photographs,” Fobbs said. “But we have had people trying to climb fences and get through doors of some of the buildings.” (Fobbs last comment was a reference to a recent climbing of the fence that the Nation of Islam’s Leon Muhammad engaged in, in an effort to determine if air quality monitoring devices near the Nation’s school and Oakdale public housing site were operating. (After Muhammad scaled the fence and reported that he’d found an empty bin where monitoring equipment was supposed to be, a kafuffle ensued, with the US EPA saying Muhammad was looking in the wrong place for the monitors which, it claimed, were in operation.)

Ultimately, Fobbs told me to call Redevelopment’s Audrey Kay if I wanted a tour, and several shipyard artists told me they would be happy to arrange a day pass so I can visit their studios and hear concerns that they will be required to move from a couple of shipyard buildings before replacement studios have been completed–an arrangement that would amount to a breach of promise that Lennar and the city previously made to the shipyard artists.

Shortly after I was turned away for a second time, POWER’s bus arrived at the gate, only to be blocked–a denial of access that meant 23 progressive planners were forced to view the shipyard from various remote viewing spots atop the hills that surround the site.

Together these episodes left me wondering what kind of political litmus test could end up being enforced at the site, if Lennar’s mega project gets the green light this summer, and what will happen if the Board decides to kick the plan back to the drawing board until the Navy completes a environmental impact statement and all of the community’s ongoing environmental and economic justice concerns are addressed.

So stay tuned, and don’t forget to mark July 13 on your calendar when the full Board of Supervisors is tentatively to hear appeals of the project’s final EIR, which the Planning and Redevelopment Commissions rubberstamped June 3. And, as always, it will be revealing to see which candidates in the hotly contested race for D. 10 supervisor, show up and speak truth to power.

 

 

Lennar’s litmus test

None of the many stakeholders tracking the progress of Lennar Corp.’s massive Candlestick Point-Hunters Point Shipyard redevelopment plan registered surprise when the Board of Supervisors received three appeals to the Planning Commission’s June 3 certification of the project’s final environmental impact report (FEIR).

Instead, everybody who has been watching the political juggernaut that has been pushing for quick approval of the project over the past month said they anticipated that the FEIR would be appealed, and perhaps litigated. But the real question is whether the project will be substantially changed.

In the seven months since the project’s draft EIR was released, the Planning and Redevelopment Commissions have repeatedly rejected all arguments and recommendations made by its critics to improve or delay the plan, rushing the approval along on a tight schedule (“The Candlestick Farce,” 12/21/09).

The rush job occurred even as numerous groups and individuals warned that the DEIR comment period was too short, (“DEIR in the headlights,” 02/03/10) and complained that the city and the developer had dismissed crucial data and testimony while exploiting fears the San Francisco 49ers would leave town if the city didn’t act quickly (“Political juggernaut,” 06/02/10).

What’s less clear is whether the Board of Supervisors has the political will to heed these appeals and correct what opponents say are serious flaws in the city’s FEIR. The appeal that the Sierra Club, Golden Gate Audubon Society, California Native Plant Society, and San Francisco Tomorrow filed June 21 lists nine deficiencies.

These included the FEIR’s failure to look into an alternate Bus Rapid Transit (BRT) route around Yosemite Slough or adequately assess impacts resulting from the landfill cap on Parcel E2 and the transfer of 20 acres of public shoreline land in Candlestick Point State Recreation Area (CPSRA) to build high-end housing.

“The FEIR failed to analyze those elements of the project’s sustainability plan that could have significant environmental impacts, including two proposed heating and cooling plants (which appear to be power plants) to serve 10,500 housing units and a projectwide recycling collection system,” the coalition further charged.

The appeal also voiced concern that the FEIR failed to adequately assess impacts resulting from the construction and maintenance of the development’s underground utility matrix, impacts to the bird-nesting in the proposed 34-acre wetland restoration project at the state park, and delays to eight Muni lines.

But the Sierra Club-led coalition also indicated that by removing provisions for a bridge over Yosemite Slough, transfer of land in the state park, and compromised clean-up efforts at Parcel E2, resolution of many of these disputed issues could be expedited.

“If the Board of Supervisors acts promptly, revisions to the EIR may be made quickly and result in a minimal delay in the progress of the project,” the coalition stated.

The Sierra Club’s Arthur Feinstein told the Guardian that the coalition’s top three concerns are “very important, but the six other issues are also very real.”

“Here we have a city cutting 10 percent of its bus service while saying that eight bus routes will need to be improved because of the project, and admitting that the development will increase air pollution in a district that has the highest rates of asthma and cancer without identifying mitigations such as reducing parking spaces in the proposal,” Feinstein said.

POWER (People Organized to Win Employment Rights) also filed an FEIR appeal June 21 listing a broader range of environmental and economic justice-related concerns.

These included the FEIR’s failure to analyze and mitigate for displacement that would be triggered in the surrounding neighborhood by developing 10,500 mostly market-rate housing units in the area and “failure to provide for adequate oversight and enforcement of the terms of the early transfer” of the shipyard from the Navy.

POWER also cited the FEIR’s failure to adequately mitigate against the impact of sea level rise, the risks associated with potential liquefaction of contaminated landfill at the shipyard in the event of an earthquake, and health risks related to chemicals of concern at the shipyard. The group also faulted the city’s failure to get the Navy to prepare an environmental impact statement on its clean-up plan before the FEIR was completed.

Finally, Californians for Renewable Energy (CARE) filed a five-point appeal June 23 charging that the project contravened the intent of Proposition P (which voters approved in 2000, urging the Navy to remediate shipyard pollution to the maximum extent possible), that the project’s FEIR is incomplete because the Navy (which still retains jurisdiction over the project lands) has not yet completed its EIS, and that the FEIR approval process was tainted by 49ers-related political pressure.

“The pre-set goal of maintaining the 49ers in San Francisco has colored the environmental analysis of this decision,” CARE noted, referring to the city’s rush to get the project’s FEIR certified on June 3 — five days before Santa Clara County voters approved a new stadium for the 49ers near Great America .

The appeal filings mean the Board of Supervisors is required to hold a hearing within 30 days, a move that places a roadblock, at least temporarily, in the way of the city’s tight schedule to secure final approvals for Lennar’s megaproject before summer’s end.

Board President David Chiu told the Guardian that the Board’s Land Use Committee will move forward with a July 13 meeting to hear a list of proposed amendments related to the underlying plan along with the FEIR appeals.

“We are back at the board Land Use Committee July 12 with 10 items related to the project,” said Chiu, who is a member of the Land Use Committee. The three-member committee is chaired by Sup. Sophie Maxwell, who represents the project’s District 10; Sup. Eric Mar is vice-chair.

“The next day, July 13, has been tentatively set for a full meeting of the full board,” Chiu continued. He acknowledged that the FEIR related materials are dense and complex, telling us that “they form the largest pile on my desk, and it’s about five inches high.”

But he wasn’t about to prejudge the outcome. “We do need to clean up the area and rebuild it in such a way that it will dramatically increase affordable housing and jobs and support a livable diverse community,” Chiu said. “Obviously there are still a lot of questions and concerns about the proposed project and the board will push to make sure all these issues are adequately addressed.”

CARE president Michael Boyd said he hoped the board would take his group’s appeal seriously and fix the plan’s fundamental shortcomings. “That means going back to square one,” he said.

But others were less sure that the board would seek to overturn the entire plan. “Everyone in the community would like the best level of clean-up,” said Saul Bloom, whose nonprofit Arc Ecology has tracked the proposed shipyard clean-up for three decades. “But what’s possible and practical? And will the city be supportive of that or the most expeditious solution?”

Bloom reserved gravest concern for plans to cap, not remove, the contaminants from the shipyard’s Parcel E2. “The concern is that if you put a cap on E2 without a liner then contaminants could scootch out during a seismic event, or over time, and cause problems because of the parcel’s close proximity to surrounding groundwater and the San Francisco Bay,” he said. “But to place a liner in there is very expensive because you’d have to excavate E2, at which point you might as well replace it with clean soil.”

Bloom acknowledged that the Navy has argued that excavation would cause a nasty smell and nobody knows what is going to be released in the process.

“But long-term Bayview residents like Espanola Jackson have made the point that the community already lives within nose-shot of the southeast sewage treatment plant and would rather put up with a few years of nasty smells, given the relative benefits of cleaning the yard up,” he said. “And how do we know a cap will be protective given the Navy’s argument that we don’t know what’s down there?

“The thing that makes the most sense here is to clean up the shipyard to the best possible extent, but the city isn’t planning to do that,” Bloom added. “And the environmental community’s bottom line has always been the bridge [over Yosemite Slough, which the Sierra Club opposes]. So the sense is that if the bridge goes away, so does their problem.”

Inflated meaning

FILM Don’t let Air Doll‘s title fool you. Mannequin (1987) or Lars and the Real Girl (2007) this ain’t. This gritty, Tokyo-set fairytale about an inflatable sex doll who comes to life represents a departure on many fronts for director Hirokazu Koreeda, who has become known for such faintly melancholy studies of quiet perseverance as Nobody Knows (2004) and After Life (1998). Despite its fantastic premise and candid eroticism, Air Doll covers similar emotional territory to those older titles, surveying with no less an empathetic eye the fickleness of human connection, the power of adoration, and the loneliness that seems to be a hallmark of urban life.

Saucer-eyed Korean actress Doona Bae (of 2005’s Linda Linda Linda fame) stars as Nozomi, the titular doll who escapes her devoted owner’s apartment and wanders through the densely packed surrounding streets. Eventually she finds employment at a video store, where she falls in love with a coworker (after he gives her one of the best and queerest BJs ever committed to film). Along the way she learns to tell lies, harbor jealousy, and experience what it’s like to have the "heart [she] wasn’t supposed to have" break. In short, what it means to be human.

All the while, Koreeda never sugarcoats Nozomi’s "vocation," letting sexually frank but never prurient episodes stand in contrast to the film’s more lighthearted moments. But, as I found out when I spoke to Koreeda the day after Air Doll screened at the 2010 San Francisco International Film Festival, that’s part of being human too. My thanks go out to Beth Cary for being such a wonderful interpreter.

SFBG You’ve never made an adaptation before. What initially attracted you to Yoshiie Goda’s manga series?

Hirokazu Koreeda There was one scene in particular that attracted me. In the video shop, when the air doll snags her arm on a nail in the wall and starts deflating and the young male clerk comes over and tends to her wound. At first she is shy and embarrassed but then she starts feeling a real sense of fulfillment and satisfaction as he blows air into her. To me it was like a sex scene, but done with the breath. Using a person’s breath as a way that people commingle and communicate was very interesting to me.

SFBG Air Doll has really divided critics. I think it’s because the film doesn’t stick to a certain tone or mood. Is this what you were aiming for?

HK In a way it was. What I discussed with Doona Bae is that the doll is born like a baby — innocent — and then learns various things about the world by imitating humans. In that process, she sees how poetic things are, how pessimistic things are, and how comedic things are, so she changes as well. I think such a mix of elements is present in our everyday lives, so I wanted the film to reflect that.

SFBG How was it working with Doona Bae? Her performance has such a Giulietta Masina-like quality to it.

HK [Laughs] Actually, before we started filming I suggested that she watch La strada (1954) and Nights of Cabaria (1957), not because I was aiming for a certain style, but because I thought they might be helpful. I also spent about five hours walking her through the entire film (with an interpreter, since she doesn’t speak Japanese). During that time even she would tear up and cry during the sad parts and laugh during all the pleasurable parts. Afterward she said, "I’ve got it. I understand the character now." And in the two months of filming, she didn’t waver from what we discussed at all. She was great.
