SAN FRANCISCO INTERNATIONAL FILM FESTIVAL Despite the incredible current spread of festivals and formats by which art films can be exposed internationally, it’s still possible for masterful directors with considerable resumes to remain largely ignored outside their own country. Certainly that’s been the case with Agustí Villaronga, a fascinating Spanish director whose new film, Black Bread, is the latest in a career of superbly crafted films almost-commercial enough to gain U.S. release. Yet seldom quite enough.

Villaronga’s cinema is gorgeously cinematic, often historical, high in strikingly managed melodramatic content, sexually (often homoerotically) charged, frequently tinged by the fantastical, very interested in children’s perceptions of adult corruption. He’s a middleman between Luis Buñuel and Guillermo del Toro — less abstract than Buñuel, but evidently less accessible than del Toro, even if the ambitious Black Bread possibly got green-lit because in many respects it resembles del Toro’s international success Pan’s Labyrinth (2006).

Black Bread isn’t its director’s best work, though as usual it sports his aesthetic assurance, flair for alarming set pieces, and potency in juggling disparate tonal-thematic elements. It’s another very dark story — he’s never made a frivolous one — addressing sex, politics, and violent suppression toward both that manages to be expansive rather than claustrophobic, or simply depressing. It is, like many of his films, a great movie … nearly.

He started out, however, with a feature that was absolutely great, and could hardly have been more upsetting: 1987’s In a Glass Cage, about Klaus (Günter Meisner), a Nazi doctor who conducted World War II “experiments” on children. Years later, he is discovered hiding out by one of his surviving victims. Angelo (David Sust) is now an Angel of Death himself, committed to punishing his erstwhile tormentor by perversely reenacting his worst crimes — with the sickly doc, now helpless prisoner of a primitive “iron lung,” as captive witness.

Angelo invades Klaus’ home with alacrity, appointing himself sole attendant “nurse,” dispatching anyone who gets between him and his goal. This goal is a sadistic tables-turning that the pale, handsome-yet-ghoulish teenager wreaks upon his host family, to the extreme peril of its members and any unwilling “guests.”

Hitchcockian in their perfect storyboarded discipline, yet without his gloating chortle, the unforgettable set piece highlights of In a Glass Cage are excruciatingly tense, prolonged death-knells for characters Angelo chooses to eliminate. Yet there’s a terrible poignancy to the cruel proceedings.

After horrifying San Francisco International Lesbian and Gay Film Festival audiences 25 years ago — there is a certain thread of malevolently closeted homoeroticism — this cult object remained long absent from North American access until a 2003 DVD release. It remains an astonishing peak in sick but brilliantly accomplished cinema.

Villaronga should have shot to the fore of international auteurs with that extraordinary debut. But instead he’s enjoyed just sporadic exposure and (I’d assume) a lot of frustration, given just four features realized in the near quarter-century since. Most are barely known here, if at all — 1989’s atmospheric if slightly overcooked fantasy Moonchild, 1997’s quasi-horror 99.9, or 2000’s The Sea, a sometimes shattering drama about three children who share a traumatic secret, then meet again as young adult patients at a sanitarium. All of them were arresting, however, and none were seen in the U.S. beyond a handful of festivals and (at best) extremely limited VHS or DVD exposure. (In a Glass Cage is showing at the Yerba Buena Center for the Arts Screening Room in May.)

Black Bread is, incredibly, Villaronga’s first theatrical feature in a decade. (He’s made the rare short, documentary, and TV project in the meantime, and is currently planning a miniseries about Eva Peron’s visit to Spain.) Based on a novel by Emili Teixidor, Black Bread is a complex narrative and stylistic hybrid blending history, homophilia-phobia, humanism, and horror, even more accessibly than before. It’s a festival crowd-pleaser that pretty much swept Spain’s Goya Awards in February, albeit sadly still no shoo-in for theatrical release hereabouts.

Largely about how childish emotions betray adult hypocrisies — a la To Kill a Mockingbird — the 1944-set Black Bread operates on several levels, all thorny but vivid. Their core is the bewildered perspective of almond-eyed Andreu (Francesc Colomer), an 11-year-old peasant child who witnesses a gruesome crime at the beginning, only to find his father (Roger Casamajor) accused by a corrupt Fascist mayor eager to scapegoat a former Republican rebel. Dad must flee, and Andreu is sent by mom (Nora Navas) to live with his grandmother and aunts until the heat dies down.

Cramming an epic agenda into 108 minutes, Black Bread encompasses roiling coming-of-age emotions, folkloric streaks, a few shocking revelations (including pederasty), and hints of fabulism in a nearby asylum-slash-death camp whose inmates include an angelic young man without (or possibly with) wings. It’s a terrifically orchestrated film, even if it feels somewhat overstuffed with ripe elements, almost over-accomplished in terms of slick showcase sequences — including a grotesque fever-dream of fag-bashing sadism — whose variably florid, stirring parts are less effective as a whole.

Still, those parts are often very stirring indeed, with excellent performances by the juvenile and adult actors. It’s a movie most viewers will find unusually rich in complication and artistry. Why Villaronga hasn’t had a half-dozen more opportunities to impress us over his skinny quarter-century output is anyone’s guess. But it’s surely everyone’s loss.

Gascon’s futility

If the April 12, 2011 breakfast meet-and-greet featuring appointed District Attorney George Gascón at a West Portal Avenue eatery constitutes a barometer of the campaign for that important public office, San Franciscans are in for a tepid exercise in municipal futility.

Sponsored by a prolific campaign contributor and restaurant owner, a Board of Permit Appeals appointee of former Mayor Gavin Newsom, and the owner of a new public relations/lobbying firm just awarded the $100,000 dollar public relations contract for Muni, the event attracted some 20 people, including Gascón’s campaign manager and fundraiser, and consisted of a stereotypical candidate presentation and a meager number of audience questions.

Revealing he’s “intrigued” by a chief of police becoming the District Attorney, Gascón described a Saturday afternoon meeting in early January with Newsom supposedly about the transition in local law enforcement arising from relinquishment of the DA’s office by the prior officeholder. According to Gascón, he was “really surprised” when Newsom declared he wanted to appoint him to the office — but Gascón had to accept the offer by 5 p.m. (Not a word did he provide his breakfast audience about Willie Brown-Rose Pak’s participation in promulgating the Newsom offer).

After claiming he “got some very good results” in his first year as police chief, Gascón recited the need for “separation” between his role as former chief and execution of prosecutorial duties. But he failed to specify, even by example, cases in which he has or will recuse himself from prosecuting in favor of the state’s attorney general — at added taxpayer cost, to be sure! (The Attorney General’s Office institutionally lacks trained criminal trial lawyers; the office responsibility pertains to defending the people in appeals from criminal trial court convictions.)

Asserting that the D.A.’s office is “understaffed and underfunded,” the political appointee then tried to describe the three sections of responsibility within the office, concentrating on so-called community courts for “low-level offenses” and “diversion courts.”

He referred to a section for “justice integrity” without defining its nature or scope. He proclaimed as novelty ” a pre-preliminary hearing” proceeding to resolve charges by “offers” for defendants pleading no contest or guilty to lesser crimes, an existing standard practice in Superior Court.

Audience questions involved the mentally ill, capital offenses, the Mental Health Court, domestic violence, and prosecution problems caused by a flawed drug laboratory, search and seizure police errors, and the like. Gascón conveyed his personal “misgivings about the death penalty,” asserted that 60 percent of Death Row prisoners are “minorities,” reminded listeners the death penalty is California law and must be followed and concluded: “I can’t say categorically I’d never seek the death penalty.” (There are currently seven cases in the District Attorney’s Office that qualify for capital punishment.)

Gascón finally stated he “is not a fan of” so-called consent searches and that he has established a 24-hour search warrant office capability for police — and he spoke of an unexplained relationship with Public Defender Jeff Adachi, who has criticized several warrantless Police Department searches.

Strikingly absent from the Gascón dissertation was any reference to attacking public corruption of the genre disclosed by the Guardian and many other sources. One also wonders whether punishment represents an object of this prosecutor’s office or whether social outcomes represent the dominant goal.

Never mentioned was the Special Prosecution Unit of the office (which once handled corruption cases), whether it still exists or, if so, what its current mission is. Never mentioned was the method of selecting judges for his proposed Community Courts.

And, as John Shanley, one-time spokesman for ex-District Attorney Terence Hallinan and a former deputy city attorney observes: “Anybody who thinks public corruption ended in San Francisco with the disgraced Ed Jew needs to reduce their dosage of medicinal marijuana.”

Lacking any questions or information on the candidate’s trial experience, prosecutorial successes, or experience as a lawyer, we still don’t know much about political appointee D.A. Gascón after one West Portal meet and greet.

Seeking a watchdog’s watchdog

When cash pumps through the guts of city politics, the Ethics Commission is charged with keeping track of it all to help members of the public follow the money. But what happens when the public loses faith in the ethics of the Ethics Commission?

In the run-up to a hotly contested mayoral race, in a city marked by rough-and-tumble politics influenced by moneyed power brokers, the function of this local-government watchdog agency is especially critical — and to hear some critics tell it, the Ethics Commission needs reform if it is to perform as an effective safeguard against corruption.

So it was hardly surprising that an April 5 discussion at the San Francisco Board of Supervisors meeting about whom to appoint to the Ethics Commission featured a low-level tug-of-war with some potentially high-level implications.

Sup. Eric Mar proposed that the board consider Allen Grossman for the seat. An octogenarian government watchdog unaffiliated with any political party, Grossman has gone so far as to file a successful lawsuit against the Ethics Commission for not following its own public-disclosure rules. As a potential appointee, he was widely viewed as reform-minded, following in the footsteps of others who have been purged from the body in recent years.

“Open government and good government work together, hand in hand,” Grossman told members of the board’s Rules Committee several weeks prior, interlacing his fingers for emphasis.

Grossman won the backing of Sups. John Avalos and Ross Mirkarimi. But Board President David Chiu spoke against the idea, throwing his support instead behind Dorothy Liu, an attorney and professional colleague of his through the Asian American Bar Association. The Rules Committee, chaired by Sup. Jane Kim and filled out by Sups. Sean Elsbernd and Mark Farrell, also turned down Grossman in favor of Liu.

“She’s extremely hard-working and does her homework,” Chiu later told the Guardian. He also saw it as a plus that Liu was not a political insider: “I think we need an individual on the Ethics Commission who will be impartial,” he said, adding that he’d prefer “someone who has not been involved in the rough-and-tumble of San Francisco politics.” Sup. Carmen Chu echoed Chiu’s comments during the meeting, saying she thought Liu would be an ideal candidate because she did not seem to have an agenda.

Mirkarimi and Avalos, on the other hand, said they were looking for a candidate who did possess a vision for strengthening the role of the agency as a watchdog. “I think our Ethics Commission and the department, as it stands, needs all the help it can get,” Mirkarimi said during the meeting. “I think having people who are well-seasoned with an understanding in the law of ethics and sunshine is something we should be looking for. Mr. Grossman has exhibited that well over the years in trying to do everything he possibly can to advance the cause in a nonpartisan way of making sure that we have a very strong Ethics Commission.”

Mar’s motion to consider Grossman was shot down on an 8-3 vote with Mirkarimi, Mar, and Avalos dissenting; Liu then won the commission appointment on a 10-1 vote, with Avalos dissenting.

Until recently, the Board of Supervisors seat on the Ethics Commission was held by Eileen Hansen, a progressive who had called for political reform under Mayor Willie Brown’s administration prior to being named to the post. When she was being considered for the commission, Hansen recalled, then-Sup. Michela Alioto-Pier raised an objection. “[She] thought the perfect person would be somebody who … would come essentially as a clean slate,” Hansen remembered. “Because I had been involved in organizing campaigns and had run for office, that was deemed too political.”

Yet Hansen viewed her familiarity with the system as an asset that helped her serve as an effective watchdog against corruption. During her six-year tenure, Hansen often cast lone dissenting votes against decisions she believed were weakening ethical standards. She told the Guardian she’d tried floating remedies for situations she viewed as inappropriate, only to have them summarily ignored, a role similar to that of former Ethics Commission member and staffer Joe Lynn.

In one case, Hansen recalled, she became concerned about a planning commissioner who also directed a nonprofit. To raise money, her organization held fundraisers that were ostensibly attended and funded by the very same developers and lobbyists who appeared before her at the Planning Commission. Yet Hansen said she was unable to persuade the other commissioners or staff to call for an investigation.

A more recent Ethics Commission vote underscores the same tension. On March 14, the commission voted unanimously to waive a pair of ethics regulations to allow a mayoral staff member to become executive director of the America’s Cup Organizing Committee (ACOC). Composed of highly influential business figures including at least two billionaire investors, ACOC is tasked with securing corporate donations for the America’s Cup to offset city costs of hosting the race.

Kyri McClellan, project manager with the Mayor’s Office of Economic and Workforce Development, helped craft a memorandum of understanding with ACOC regarding its fundraising obligations to the city. In her new job, without skipping a beat, she’ll interface with the city on behalf of ACOC. The rules that were waived for her benefit are meant to prevent city officials from holding undue influence over their former coworkers after leaving public service, and to prevent city staffers from accepting money from city contractors right after departing from city employment.

“If I had been there, there would have been at least one vote against that waiver,” said Hansen, whose term on the commission ended before this vote. “We have this law in place for a reason. By continuing to provide waivers … we create a situation where the public will not trust the Ethics Commission as a watchdog.”

Hansen said she was scouting for a new commissioner who would carry on with her work. “I was looking for and trying to recruit a visionary — someone who could really be a reformer,” she said. “We’re almost in a position now where we need a watchdog over the watchdog.” She said she saw Grossman as the right fit.

Other observers, such as CitiReport blogger Larry Bush — an investigative reporter who called for the creation of the Ethics Commission in San Francisco in the early 1990s — questioned whether Liu was the best choice after hearing her statements at the March 17 Rules Committee hearing. Liu did not come out strongly in favor of televising Ethics Commission meetings, which has long been a sticking point for open-government advocates.

“I absolutely support televising the Ethics Commission, I think it’s really important,” Kim noted when we asked her about this. She added that she would have supported Oliver Luby — a former Ethics Commission staff member and whistleblower who was ultimately ousted from the job — if he’d applied.

Kim noted that an initial concern she’d had in seeking an ethics commissioner was whether the person would vote to allow Mayor Lee to resume his job as city administrator after serving out his term as interim mayor, a key decision that the commission was scheduled to consider April 11.

Once she was advised that it would be inappropriate to ask which way they would vote when conducting candidate interviews, Kim said she withheld her question — and still didn’t know Liu’s or Grossman’s position at the time she spoke with the Guardian. “I think it’s very appropriate for him to get his job back,” Kim noted. “That vote is very important to me.”

That vote drew closer scrutiny, however, after Ethics Commission staff recommended that the exemption that would be built into the law for Lee’s benefit should be expanded to include appointed members of the Board of Supervisors. “This new proposal would convert a targeted, narrow exemption to deal with a special case into the ‘Politician Job Protection Act’ and could open the door to all kinds of unintended consequences,” charged Jon Golinger of San Franciscans for Clean Government.

Meanwhile, Luby seemed disheartened by the board’s selection of Liu for the Ethics Commission. He was looking to Grossman to fill Hansen’s shoes as the commission’s reformer — a role previously held by Lynn, Luby’s good friend and mentor who died last year.

He lamented, “This will mark the first time in over 10 years to have an Ethics Commission without someone who has past experience advocating for good government.”

Can somebody pleae explain why the United States government is spending all this money trying to put someone in jail who is clearly no threat to society, already has had his career ruined (unlike the Wall Street guys who actually damaged the economy and got away not only without criminal charges but with increased riches) and at worst, lied about something that he knew would leak out?


Remember: Bonds was worried from the start that his grand jury testimony would not remain confidential. And it didn’t.


I don’t know. The case is weak, the prosecution is weak, I don’t care about the size of his testicles and this is all costing the taxpayers millions of dollars. Why can’t the U.S. attorney prosecute some real bad guys? How about investigating municipal corruption?


Okay, I’m done now.

St. Stupid’s Day Parade mocks economic and religious institutions

The 33rd Annual St. Stupid’s Day Parade careened through the Financial District this afternoon, with hundreds of colorful self-styled idiots offering spirited and incisive send-ups of corporate and religious power and clearly having a great time in the process.

The always lively April 1 countercultural ritual was infused by fabulous weather and a nearby gathering of Burning Man regional representatives from around the world, a conference at the Bently Reserve where head honcho Larry Harvey will be giving a heavily touted speech this evening in which he’s expected to announce the formation of a nonprofit group that will eventually take over Burning Man from Black Rock City LLC.

But it’s tough to upstage the First Church of the Last Laugh on its holiest of days, and the crew led the parade of costumed followers through some of its regular rituals, including the tightening of the lug nuts that connect old San Francisco to the new landfill at Battery and Bush streets and throwing socks at the old Pacific Stock Exchange Building.

Along the way, they stopped to make noise and jokes directed at the Federal Reserve, Well Fargo, Bank of America, and other titans of capitalism and corruption, offering chants that included “Go back to work” and “No more chanting.” Lobbies were raided and icons mocked, but with such a good nature and self-deprecating style that even the initially nervous-looking suits and security guards ended up smiling.

Happy St. Stupid’s Day, everyone, now go have some fun.

 

 

Progressive pension reform

EDITORIAL It’s entirely possible that San Francisco voters will see three different pension proposals on the November ballot. Public Defender Jeff Adachi, who failed to pass a harsh pension-reform plan last year, is determined to try again. A working group headed by investment banker Warren Hellman is working on a plan, and Sup. Sean Elsbernd expects some version of that to move forward. And organized labor may do its own initiative.

But before any of those efforts are finalized, it’s worth understanding where this so-called crisis originated — and how to fashion a progressive approach to the issue.

The idea behind San Francisco’s fixed-benefit system is simple. Every year, the city and it’s employees contribute to a pension fund, which is invested under strict rules, and when an employee retires, he or she gets paid a predetermined amount out of that fund. Until the financial system imploded and the stock market crashed in 2008, San Francisco’s pension fund was solid. The reserves more than covered expected payouts. In fact, the fund was so healthy, and growing so fast, that some years the city didn’t have to contribute anything at all.

Under Mayors Willie Brown and Gavin Newsom, the city used its flush pension fund as a way to avoid tough decisions on employee pay. Instead of giving raises, for example, the city offered to pick up the contributions some workers were making to the fund (which would cost the city nothing as long as the stock market kept booming).

Now things aren’t so rosy, and the city’s having to put hundreds of millions a year into the fund to keep it solvent. For the record, that’s not the fault of the city employees who negotiated their contracts in good faith — and who weren’t players in the Wall Street greed and corruption that wrecked the economy. In fact, if the city had continued paying into the fund in good times, the costs would be far lower now.

The various pension proposals look at a wide range of approaches, but in essence, both Adachi and Hellman’s group are going to ask city employees to put more of their paychecks into the pension fund. That’s the equivalent of a pay cut — they’ll be taking home less money for the same benefits they currently receive.

It’s true that city employees now get better pensions than most private-sector workers (a result in part of the fact that corporate American, aided by Congress, shifted most retirement plans to the 401(k) model, which puts all the risk on the employees and leaves employers largely off the hook). And there’s some horrendous abuse, particularly by senior police and fire staffers (former Police Chief Heather Fong is getting $229,000 a year for life, which is ridiculous).

It’s also true that the average midlevel city worker gets a pension between $20,000 and $24,000 a year.

Labor has already given back some $500 million in concessions over the past four years (and most of that money has come from lower and midlevel workers) City programs and services have been cut, by most estimates, by close to $1 billion.

The city has raised only $90 million in new taxes.

The bottom line is that over the past four years, the rich and big corporations, which are radically undertaxed in our society, have given back almost nothing to the city, have felt almost no pain. Unless pension reform takes that into account, it won’t be fair or acceptable.

The first element of any new pension plan should be progressive in scale: capping pensions at, say, $100,000 (or lower); eliminating pension spiking; and requiring high-paid employees to contribute a higher percentage to the fund than low-paid workers would make sense. Policy makers should treat this as what it is, a pay cut — and any cuts should fall disproportionately on those who are more able to afford it. Requiring the city to put its share into the fund every year, even if the market is booming, would help ease the pain in bad years.

But there should be no pension reform without tax reform. If San Francisco is going to ask its employees to do more to balance the local budget — and that probably has to happen — then city officials should be willing to ask the richest residents and businesses to share the pain too.

A call to do your (jury) duty

OPINION For decades San Franciscans concerned and interested in the workings — and malfunctions — of city government have turned to the Guardian for insights and possible solutions. Guardian readers have developed a reputation for being community activists, and to those activist-minded readers, I encourage you to apply to serve on the San Francisco civil grand jury.

Few citizens understand that the California Constitution requires all counties to impanel a civil grand jury each year. The San Francisco grand jury has researched and issued many important findings — most recently, pertinent reports on the enormous, and growing, city employee retirement obligations threatening to consume our city’s general fund and possibly bankrupt the city in the next five years if not resolved.

Each year the San Francisco Superior Court accepts applications from citizens who want to serve on the jury. Thirty screened applicants are selected, and from those 30, 19 are impaneled as that year’s civil grand jury. Jurors serve for a one-year term, from June to July.

The full jury discusses various issues of interest, selects issues that gain 12 of the 19 votes, spends a year investigating, then writes and releases reports. The panel can investigate any function of city government — contracts, corruption, spending, tax policy .. the mandate is very broad. And the jury has tremendous power, including the ability to subpoena records and force city officials to testify. No pertinent information may be withheld once the judge approves the request.

But the dilemma confounding the court is the lack of qualified applicants. In 2009, the number of applicants was so low we were nearly unable to impanel a jury at all. What a disgrace, in activist San Francisco.

I find it so disheartening that in a city renowned for community interest and participation in almost every aspect of government activity, we have such a small number of citizens willing to make the time to serve.

So I appeal to Guardian readers to direct your interest in the workings of our city government, to consider putting your knowledge and commitment to better city governance by serving on the San Francisco civil grand jury.

The owner of a certified minority-owned business in San Francisco is suing the city, charging that his telecommunications company went belly up after city officials falsely accused him of participating in a fraudulent kickback scheme within the city’s Department of Building Inspection (DBI).

The case and depositions of high-ranking officials offer a rare window into the inner workings of city government at a time when corruption was rife within DBI and regulations governing city contracting were considerably less strict. They also provide a glimpse at how city business was sometimes conducted under the administration of Mayor Willie Brown, a powerful figure who has resurfaced recently in San Francisco politics.

In addition, the case alleges inappropriate behavior by current Mayor Ed Lee when he was the city’s purchasing director. One of the depositions includes allegations that Lee, at Brown’s direction, approved a city contractor who was utterly unqualified and was later accused of being part of a criminal scam.

The plaintiff in the lawsuit — James Brady, CEO of Cobra Solutions — closed up shop years ago and moved to Sacramento with his wife and business partner, Debra. But he’s been locked in an ongoing legal battle against powerful forces in City Hall since 2003, when he claims the city stopped issuing payments to his company, terminated its contract, and declined to award it a new contract on suspicions of bribery.

“They want to make us look like we’re Bonnie and Clyde,” Brady told the Guardian. “We’ve never done a thing.”

Nancy Fineman, an attorney with the firm Cotchett, Pitre & McCarthy, which is representing the city in the case, said the corruption allegations against Cobra still stand and she emphasized, “The city attorney was not involved in doing anything wrong.”

In a complaint filed Jan. 7, attorney G. Whitney Leigh — law partner of former Board of Supervisors President Matt Gonzalez — alleges that a host of city officials are responsible for precipitating Brady’s financial ruin.

According to Leigh’s version of events, Cobra was dragged into an overzealous campaign to hold someone accountable after a contractor the city alleged was corrupt vanished, leaving a number of subcontractors unpaid and the city “with egg on its face.”

Leigh subpoenaed Ed Harrington, former city controller and current head of the San Francisco Public Utilities Commission; Deputy City Controller Monique Zmuda; former officials from the Office of Contract Administration, and others to testify out of court during discovery. Leigh describes the case as “a Shakespearean tragedy combined with a cartoon combined with a soap opera.”

For City Attorney Dennis Herrera, it might be more like a zombie flick. The city attorney is gaining momentum in his campaign for mayor and has taken an early lead in fundraising against his opponents. The Cobra Solutions saga might be one that he — and other top city officials — would rather forget.

 

CONFLICTS AND CRACKDOWNS

Appeals in the case have reached all the way to the California Supreme Court, which ruled that Herrera had a conflict of interest that should have disqualified his office from suing Cobra. Beginning in September 2000, before he was elected city attorney, Herrera provided legal representation to Cobra while working with a private firm called Kelly, Gill, Sherburne & Herrera.

Due to the disqualification, Herrera could not discuss specifics in the case. But he did offer us a general comment. “I’ve made it very clear that me and my office are going to have zero tolerance for corruption and individuals who would violate the public trust,” he said. “This case, I think, represents that philosophy.”

When Herrera was campaigning for city attorney in the November 2001 race, he ran on a platform of cracking down on fraud and corruption. The DBI case began as a triumphant delivery of that campaign promise.

In 2003, following a yearlong investigation by a Public Integrity Task Force that Herrera had convened, a corrupt DBI official named Marcus Armstrong got busted by the feds. He’d allegedly falsified the qualifications on his resume and set up shell companies to funnel money out of city coffers for his own personal gain. He pleaded guilty to corruption charges brought by the U.S. Attorney, and spent time in prison for cheating the city out of about $500,000.

Herrera brought a civil suit against Armstrong and a DBI contractor, Government Computer Sales, Inc. (GCSI), which allegedly partnered with Armstrong in a kickback scheme. Questions surrounded GCSI from the start. It only gained certification as a city contractor after being rejected multiple times by city staff as unqualified. Deborah Vincent-James, who directed the city’s Committee on Information Technology (COIT) at the time and has since died, testified in a 2008 deposition that GCSI was “fraudulent” and got the contract only because of ties to Mayor Brown.

Herrera hit a stumbling block when he amended the complaint to name Cobra Solutions and its management company, TeleCon Ltd., as another city contractor in on Armstrong’s kickback scheme. (Debra Brady was president of TeleCon, which predated Cobra. Although the Bradys insist the two entities were separate, Herrera named TeleCon in the suit as an alter ego of Cobra.)

Cobra struck back, claiming the City Attorney’s Office wasn’t entitled to file suit against the company because Herrera’s old firm had represented Brady. Herrera told us the whole thing came about “because of the 18 minutes that I billed to work for Cobra.”

Herrera’s office initially denied any conflict of interest. “Immediately upon discovery of Cobra’s role, the office screened Herrera off from further involvement in the investigation and all matters related to it in accordance with a stringent ethical screening policy Herrera established when he took office,” according to a statement issued by the City Attorney’s Office.

But the Supreme Court disagreed in a 2006 ruling. “The possibility that the City Attorney’s former client might be prosecuted for civil fraud by the City Attorney’s office may test public faith in the integrity of the judicial system,” the ruling stated, “raising the specter of perceptions that the former client will be treated more leniently because of its connections, or more harshly because of leaked confidences.”

 

COBRA’S CASH

The city’s lawsuit alleged that Cobra paid Armstrong about $240,000 in bribes in exchange for $2.4 million worth of business with DBI from April 1999 through 2000. The allegation was based on checks Cobra sent to Monarch Enterprises, which the city said was an Armstrong front. The investigation found that GCSI paid Armstrong about 10 percent of the contract amount in a similar fashion.

“Armstrong used these and all other funds received from Cobra for his personal benefit and gain,” the suit claimed. The complaint also charges, “Cobra … knew that Monarch enterprises was wholly owned and controlled by Armstrong, and that any payment made by Cobra was in fact a payment to Armstrong.”

But Cobra’s suit claims an FBI investigation into Cobra’s involvement found no wrongdoing. Additionally, “We turned all of our records over to the U.S. Attorney,” Leigh noted, and that didn’t lead to a criminal prosecution.

Brady calls the corruption allegation “a big lie,” and says his company’s name has been wrongfully sullied. He says Armstrong led him to believe Monarch Enterprises was an Internet company performing training, support, and computer security upgrades as a subcontractor. The bills came in, and Cobra believed it was responsible for paying for the service, Brady said. “We mailed the checks, and never thought about it.”

Before the trouble started, Cobra Solutions was in a growth phase, having gone from four employees to 35 in just a few years. James and Debra Brady moved from Colorado to San Francisco in the late 1980s with nothing. James Brady worked as a manager in several SROs, became a member of the Tenderloin Merchant’s Association and helped establish a credit union serving low-income residents.

The couple established TeleCon Ltd. and started out as city subcontractors providing voicemail services. At first, they had very limited resources. “Prior to being able to afford an office, Debra frequently used the telephones in the women’s lounge at Nordstrom to conduct business,” according to her bio.

Cobra was established after Vincent-James urged the Bradys to submit a bid for an upcoming contract. The city had opened up a Request for Proposals (RFP) for vendors who wanted to be admitted to the Computer Store, an entity created to speed up municipal orders for technical services.

Before then, it could take six months for the city to purchase so much as a desktop computer. A Human Rights Commission vetting process, designed to ensure that city contractors adhered to environmental and social justice criteria, caused long delays. Then-City Purchaser Ed Lee created the Computer Store to solve this logistical challenge. Vendors who applied for membership were vetted in the RFP (minority-owned businesses were given preference), admitted as certified contractors, and granted preference by city departments in need of IT services.

Cobra’s first departmental contract through the Computer Store was a $1.3 million agreement to provide technical services for DBI, working with Armstrong. Things got off to a rough start.

“We could never find the guy, he would never be at work, and when we did see him, he was complaining,” Brady recounted. According to Cobra’s complaint, “it ran into a series of disputes with DBI and Armstrong over the scope of work and particular payment issues,” and Cobra was eventually awarded a settlement reflecting services it provided after Armstrong changed the scope of the work.

Brady says he sought city help in dealing with Armstrong. According to Cobra’s complaint, he appealed for assistance to COIT, which oversaw the Computer Store. Cobra’s relationship with Armstrong soon soured, and the DBI deal dissolved.

According to the description of Vincent-James, “The relationship between James Brady … and Marcus got worse … Marcus got another company involved because James Brady would not do what Marcus wanted to do.”

The other company was GCSI.

 

NEW PHASE

Things got better for the Bradys before they got worse. Cobra became one of the city’s largest technology services providers, netting $14.5 million in contracts with various city agencies by 2003. They relocated to a nicer, more spacious office in the Financial District.

A partnership with IBM granted them access to higher credit limits than ever. The couple had a home custom-built in El Sobrante. When GCSI vanished without a trace, Vincent-James called on Cobra to hire some of the GCSI subcontractors who had gotten burned in the process, according to a deposition from former city purchaser Judith Blackwell.

By 2003, the Public Integrity Task Force’s DBI investigation was in full swing, but Brady didn’t know it. He says he started experiencing problems getting paid, yet couldn’t get an explanation from city agencies.

According to Cobra’s complaint, “The city intentionally frustrated payments to Cobra and TeleCon because investigators hastily and incorrectly concluded that the companies had conspired with Armstrong in a GCSI-type scheme to defraud the city.”

Fineman, the city’s attorney, said she strongly disagrees with “the idea that we just stopped and left them in the lurch,” emphasizing that there had been a whole separate legal proceeding arising out of the fact that “Cobra was not paying its subcontractors,” in violation of its contract.

The city defended its decision to delay Cobra’s payments by pointing to the GCSI scandal, which had left city agencies high and dry. “By the time the City discovered GCSI’s fraud and stopped making payments to GCSI, GCSI had already received millions of dollars in city payments that were not then passed on to the subcontractors,” a letter from the City Attorney’s Office to Brady’s attorneys explained. “Once the city started investigating the payments to GCSI that Marcus Armstrong authorized, GCSI’s assets, officers and staff disappeared. … The city has an obligation to its taxpayers to prevent the GCSI scenario from unfolding with regard to Cobra / TeleCon.”

Brady insists that because Cobra couldn’t get paid, it couldn’t pay its subcontractors, or its creditors, either — and the financial holdup triggered a cascade of losses. “I’ve got IBM, Booz Allen Hamilton, and American Express breathing down on me like a dragon,” he said. “Everybody wants to get paid. We owed folks after we couldn’t collect our receivables.”

The bills were piling up. “We were sinking fast,” said Debra Brady, “so we sold our house in El Sobrante.”

Brady said he was stunned to learn that Cobra had been named in Herrera’s suit.

“I have 37 employees, and I had to go in and tell them. I was all choked up and the phone was ringing, and it was my attorney on the line telling me that the FBI was coming. I could not believe that after everything we had achieved in the last three years, my former attorney was filing a lawsuit against me.”

 

CLEARING THEIR NAMES

After filing the complaint against Cobra, the City Attorney’s Office called on the company to submit to an audit — but Cobra refused on the basis that Herrera’s firm had represented it in the past. “The City Attorney’s assumption of the role of auditor seems calculated to exacerbate and expand the existing conflict of interest,” Cobra attorney Ethan Balogh wrote in an April 2003 letter. “This problem could easily be solved by allowing an agency other than the City Attorney to conduct the audit.”

In a lengthy back-and-forth, Herrera’s office responded: “You have never explained why your client, having been caught sending over $240,000 in cash to a San Francisco IT manager who authorized over $2.4 million in payments to Cobra/TeleCon during the period of time which he received those payments, has elected not to immediately … open its books and records to the city. Instead … you have raised a host of constantly-shifting objections and arguments as to why the city’s demand was inappropriate.”

Cobra’s lawsuit charges that the City Attorney’s Office never informed the Controller’s Office that Cobra would have allowed an audit by another party. At the same time, it charges, city attorneys weren’t allowing Cobra to communicate with the controller directly, due to the legal dispute.

“The question of who would do the audit and whether or not the City Attorney was doing the audit was not something that I was aware of or certainly had not agreed to,” Deputy City Controller Monique Zmuda said during her deposition.

Meanwhile, Cobra had received the highest Human Rights Commission score of any bidder for a renewal on the Computer Store contract, an HRC document shows. Brady received a letter stating that his company would be awarded a new Computer Store contract — but shortly after, he got a second letter reversing that award.

Judith Blackwell, who oversaw city purchasing under Brown’s administration, explained why during her deposition with Leigh. After Cobra’s bid evaluation, Blackwell testified, her office moved to award the contract — but the controller intervened, saying Cobra shouldn’t be awarded a new contract because of the Armstrong scandal. Blackwell wasn’t willing to throw Cobra out, however.

“I learned from watching politics that I cannot afford to bend the rules,” Blackwell testified. “If I step outside the precise boundaries in any way, or if any African American administrator does, they are probably not going to be interpreted in the same way as if anyone else did it. Based on the … procurement code, there is no way that I could, as the purchasing director, just throw them out.”

Blackwell testified that Zmuda requested that she sign paperwork denying Cobra the contract, and Blackwell received a warning when she refused. “She told me that I needed to remember that when [Mayor Brown] was gone that they, the Controller’s Office, and [Chief of Staff Steve Kawa] — I knew that is what she was implying — were in charge,” Blackwell said. Once Mayor Gavin Newsom replaced Brown, Blackwell was let go. She now lives in New York City.

Blackwell testified that losing her job came as a surprise, since she’d worked on Newsom’s campaign and expected to keep her position. “I had asked him something about why it happened and he said … he knew nothing about it and people were acting without, you know, basically not at his direction,” Blackwell testified. “I said, well, Mayor Newsom, you are in charge. And his response was, oh, I wish that were so.” 

 


ED LEE APPROVED UNQUALIFIED CONTRACTOR ACCUSED OF CORRUPTION

GCSI — a company accused of defrauding the city after improperly being given a city contract by Ed Lee, allegedly at the urging of then-Mayor Willie Brown — is long gone.

“I don’t think they’re around,” Nancy Fineman, an attorney representing the city, told the Guardian. “We’ve just been focused on Cobra and TeleCon.”

The story of how GCSI came to be a city contractor may be the most fascinating part of this case, one that could have repercussions today, even though it happened in the late-1990s.

Like Cobra Solutions, GCSI was a contractor with the city’s Computer Store — gaining admission after being repeatedly rejected by city staff, according to a 2008 deposition with former COIT director Deborah Vincent-James, who has died.

Vincent-James testified that GCSI didn’t meet the minimum qualifications and recounted how, during an interview with city officials about the bid, a member of the City Attorney’s Office noticed a wire peeking out from the suit of a GCSI representative who had been surreptitiously taping the meeting.

“San Francisco was not aware of GCSI’s wrongful conduct, financial problems, or legal difficulties at the time it hired GCSI to work on the DBI projects,” a city lawsuit claimed. Nor had the city realized that, “GCSI’s president and owner had been arrested and imprisoned by a federal judge for contempt of court and for disbursing funds in an effort to avoid …efforts to collect its loan.”

GCSI principal Robert Fowler resided in both Washington, D.C., and California, was believed to be a citizen of Sweden, and was also the director and owner of a bank located on the Caribbean island of St. Vincent, according to Herrera’s complaint.

“From day one, I knew that they were not qualified,” Vincent-James’ deposition transcript reads. She went on to say that the official city process for evaluating contractors was “totally bypassed.” Nonetheless, “We had to admit them to the Computer Store.”

“Who told you, you had to admit them to the Computer Store?” attorney Whitney Leigh asked.

“The director of purchasing,” states Vincent-James’ deposition transcript. “Ed Lee.”

She went on to testify that Lee had been acting under the direction of Mayor Brown. According to her deposition, “[Lee] was directed by the Mayor’s Office and told to do an evaluation process. They evaluated them. They were put in the store.” She also testified, “Principals of GCSI hired an attorney who had been in the State Legislature with Mayor Brown and … GCSI had felt that because we were asking intrusive questions during the oral interview, such as ‘Why do you have that wire hanging out of your coat?’ … They felt that biased the committee toward … not hiring them.”

Neither Brown nor Mayor Lee’s office responded to requests for comment.

GCSI is still a codefendant in the complaint, but the principals of the defunct company seem to be off the hook. A 2008 story from the Anchorage Daily News noted that Fowler had emerged as the head of a natural gas company in Alaska. The Bradys, meanwhile, are getting ready for another court date in March. “We keep going to court,” Debra Brady said. “I’m kind of like, when is the end coming?”

You can argue about what the word “progressive” means, and you can argue about the process and the politics that put Ed Lee in the Mayor’s Office. And you can talk forever about which group or faction has how much of a majority on the San Francisco Board of Supervisors, but you have to admit: this city has just undergone a significant political realignment.

Some of that was inevitable. The last members of the class of 2000, the supervisors who were elected in a rebellion against the sleaze, corruption, and runaway development policies of the Willie Brown administration, have left office. Gavin Newsom, the mayor who was often at war with the board and who encouraged a spirit of rancor and partisanship, is finally off to Sacramento. For the first time since 1978, the supervisors will be working with a mayor they chose themselves.

For much of the past 15 years, progressive politics was as much about stopping bad things — preventing Brown and then Newsom from wrecking the city — as it was about promoting good things. But the “politics of anti,” as San Francisco State political scientist Rich DeLeon describes is, wasn’t a central theme in the November elections, and this generation of supervisors comes into office with a different agenda.

Besides, one of the clear divisions on the board the past seven years was the Newsom allies against the progressives — something that dissipated instantly when Lee took over.

But the realignment goes deeper.

Until recently, the progressives on the board had a working majority — a caucus, so to speak — and they tended to vote together much of the time. The lines on the board were drawn almost entirely by what Newsom disparagingly calls ideology but could more accurately be described as a shared set of political values, a shared urban agenda.

There are still six supervisors who call themselves progressives, but the idea that they’ll stick together was shattered in the battle over a new mayor — and the notion that there’s anything like a progressive caucus died with Board President David Chiu’s election (his majority came in part from the conservative side, with three progressives opposing him) and with Chiu’s new committee assignments, which for the first time in a decade put control of key assignments in the hands of the fiscal conservatives.

 

A PROGRESSIVE MAJORITY?

The progressive bloc on the board was never monolithic. There were always disagreements and fractures. And, thanks to the Brown Act, the progressives don’t actually meet outside of the formal board sessions. But it was fair and accurate to say that, most of the time, the six members of the board majority functioned almost as a political party, working together on issues and counting on each other for key votes. There was, for example, a dispute two years ago over the board presidency — but in the end, Chiu was elected with exactly six votes, all from the progressive majority that came together in the end.

That all started to fall apart the minute the board was faced with the prospect of choosing a new mayor. For one thing, the progressives couldn’t agree on a strategy — should they look for someone who would seek reelection in November, or try to find an acceptable interim mayor? The rules that barred supervisors from voting for themselves made it more tricky; six votes were not enough to elect any of the existing members. And, not surprisingly, some of the progressives had mayoral ambitions themselves.

When state Assemblymember Tom Ammiano — who would have had six votes easily — took himself out of the running, there was no other obvious progressive candidate. And with no other obvious candidate, and little opportunity for open discussion, the progressives couldn’t come to an agreement.

But by the Jan. 4 board meeting, five of the six had coalesced around Sheriff Mike Hennessey. Chiu, however, was supporting Ed Lee, someone he had known and worked with in the Asian community and whom he considered a progressive candidate. And once it became clear that Lee was headed toward victory, Sup. Eric Mar announced that he, too, would be in Lee’s camp.

A few days later, when the new board convened to choose a president, the progressive solidarity was gone. Sups. David Campos, John Avalos, and Ross Mirkarimi, now the solid left wing of the board, voted for Avalos. Chiu won with the support of Mar, Sup. Jane Kim, and the moderate-to-conservative flank.

Now the Budget Committee — long controlled by a progressive chair and a progressive majority — will be led by Carmen Chu, who is among the most fiscally conservative board members. The Land Use and Development Committee will be chaired by Mar, but two of the three members are from the moderate side. Same goes for Rules, where Sup. Sean Elsbernd, for years the most conservative board member, will work with ideological ally Sup. Mark Farrell on confirming mayoral appointments, redrawing supervisorial districts, and promoting or blocking charter amendments as Kim, the chair, does her best to contain the damage.

You can argue that having independent-minded supervisors who don’t vote as a caucus is a good thing. You can also argue that a fractured left will never win against a united downtown. And both arguments have merit.

But you can’t argue any more that the board has the same sort of progressive majority it’s had for the past 10 years. That’s over. It’s a new — and different — political era.

What happens now? Will the progressives hold enough votes to have an influence on the city budget (and ensure that the deficit solutions include new revenue and not just cuts)? What legislative priorities will the supervisors be pushing in the next year? How will the votes shake out on difficult new proposals (and ongoing issues like community choice aggregation)?

Mayor Lee has pledged to work with the board and will show up for monthly questions. How will he respond to the sorts of progressive legislation — like tenant protections, transit-first policies, immigrant rights measures, and stronger affordable housing standards — that Newsom routinely vetoed?

How will this all play out in a year when the city will also be electing a new mayor?

 

IDENTITY POLITICS?

When Sups. Chiu, Mar, and Kim broke with their three progressive colleagues to support Chiu for board president — just as Chiu and Mar helped clear the path for Ed Lee to become mayor days earlier — it seemed to many political observers that identity had trumped ideology on the board. There’s some truth to that observation, but it’s too simple an explanation. There’s also the fact that Chiu strongly supported Kim, who is a personal friend and former roommate, in her election, so it’s no surprise she went with him for board president.

And the phrase itself is so laden with baggage and problems that it’s hard to talk about. It has come to signify a wide range of political activity and theorizing founded in the shared experiences of injustice of members of certain social groups. “Rather than organizing solely around belief systems, programmatic manifestoes, or party affiliation, identity political formations typically aim to secure the political freedom of a specific constituency marginalized within its larger context,” says the Stanford Encyclopedia of Philosophy, an ongoing research project by the students and faculty at Stanford University.

Although the notion of identity politics took hold during the social movements of the 1960s and ’70s — when liberation and organizing movements among women and various ethic and other identity groups fed a larger liberal democratic surge that targeted war, economic inequity, social injustice, and other issues — it’s also a political approach that has divided the populace.

“One of the central charges against identity politics by liberals, among others, has been its alleged reliance on notions of sameness to justify political mobilization,” says the Stanford Encyclopedia. “Looking for people who are like you rather than who share your political values as allies runs the risk of sidelining critical political analysis of complex social locations and ghettoizing members of social groups as the only persons capable of making or understanding claims to justice.”

Mar explains that the reality of identity politics and whether it’s a factor in the current politics at City Hall is far more complex.

“With me, David Chiu, and Jane Kim as a block of three progressive Asians — and I still define David Chiu as a progressive though I think some are questioning that — we all come out of what I would call a pro-housing justice, transit-first, and environmental sustainability [mindset],” Mar told us. “But I think because of our ethnic background and experiences, we may have different perspectives at times than other progressives.”

For example, Mar said, many working class families of color need to drive a car so they’ll differ from progressives who want to limit parking spaces to discourage driving. He also has reservations about the proposed congestion pricing fee and how it might affect low-income drivers.\

“I think often when progressive people of color come into office — Jane Kim might be one of the best examples — that sometimes there’s an assumption that her issues are going to be the same as a white progressive or a Latino progressive,” he said. “But I think kind of the different identities that we all have mean that we’re more complex.”

Campos, a Latino immigrant who is openly gay, noted that “as a progressive person of color, I have at times felt that the progressive movement didn’t recognize the importance of identity politics and what it means for me to have another person of color in power.”

But, he added, “I don’t think identity politics alone should guide what happens. A progressive agenda isn’t just about race but class, sexual orientation, and other things. It’s not enough to say that identity politics justifies everything.”

University of San Francisco political science professor Corey Cook told the Guardian that identity has always been a strong factor in San Francisco politics, even if it was overshadowed by the political realignment around progressive ideology that occurred in 2000, mostly as a reaction to an economic agenda based on rapid development and political cronyism.

“I’m not sure that identity wasn’t relevant, but it was swamped by ideology,” Cook told the Guardian. Now, he said, another political realignment seems to be occurring, one that downplays ideology compared to the position it has held for the last 10 years. “I’m not sure that ideology is dead. But the dynamics have definitely changed.”

Cook sees what may be a more important change reflected in Chiu’s decision to put the political moderates in control of key board committees. But he said that shift was probably inevitable given the difficulties of unifying the diverse progressive constituencies.

“It’s hard to hold a progressive coalition together, and it’s amazing that it has lasted this long,” he said.

There’s another kind of identity politics at play as well — that of native San Franciscans, who often express resentment at progressive newcomers talking about what kind of city this is, versus those who see San Francisco as a city of immigrants and ideas, a place being shaped by a wider constituency than the old-timers like to acknowledge.

“I’m honored to join Sups. Elsbernd and Cohen in representing the neighborhoods they grew up in,” Sup. Mark Farrell said during his opening remarks after being sworn in Jan. 8., sobbing when he thanked his parents for their support.

As he continued, he fed the criticism of the notion of ideology-based politics that has been a popular trope with Gavin Newsom and other fiscal conservatives in recent years, telling the crowd he wanted “to turn City Hall into a place based on issues and ideas, not ideology.”

Cohen also placed more importance on her birthright than on her political philosophy, telling stories about entering board chambers through the back door at age 16 when she was part of a youth program created by then-Mayor Frank Jordan, and with former Mayor Dianne Feinstein coming to speak at Cohen’s third-grade class. “I am a San Francisco native, and that is a responsibility I take seriously,” said Cohen, who graduated from the Emerge Program, which grooms women for political office,

“We will have another woman as president of the Board of Supervisors, and we will have a woman as mayor of San Francisco,” she added. And as the sole African American on the board, she also pledged, “I will be working to add more members of the African American community to the elected family of San Francisco.”

But what issues she plans to focus on and what values she’ll represent were unclear in her comments — as they were throughout her campaign, despite the efforts of journalists and activists to discern her political philosophy. In her public comments, her only stated goal was to build bridges between the community and City Hall and let decisions be guided by the people “not political ideologies.”

Oftentimes in recent San Francisco history, identity and ideology have worked in concert, as they did with former Sup. Harvey Milk, who broke barriers as the first openly gay elected official, but who also championed a broad progressive agenda that included tenants rights, protecting civil liberties, and creating more parks and public spaces.

Sup. Scott Wiener, shortly after being sworn into office, acknowledged the legacy of his district, which was once represented by Milk and fellow gay progressive leader Harry Britt, telling the crowd: “I’m keenly aware of the leadership that has come through this district and I have huge shoes to fill.”

Yet Wiener, a moderate, comes from a different ideological camp than Milk and Britt and he echoed the board’s new mantra of collaboration and compromise. “I will always try to find common ground. There is always common ground,” he said.

 

GETTING THINGS DONE?

Chiu is making a clear effort to break with the past, and has been critical of some progressive leaders. “I think it’s important that we do not have a small group of progressive leaders who are dictating to the rest of the progressive community what is progressive,” he said.

While he didn’t single out former Sup. Chris Daly by name, he does seem to be trying to repudiate Daly’s leadership style. “I think that while the progressive left and the progressive community leaders have had very significant accomplishments over the past 10 years, I do think that there are many times when our oppositional tactics have set us back.”

When Chiu was reelected board president, he told the crowd that “none of us were voted into office to take positions. We were voted into office to get things done.”

Some progressives were not at all happy with that comment. “I thought that was a terrible thing to say,” Avalos told the Guardian, arguing the positions that elected officials take shape the legislation that follows. As an example, he cited the positions that progressive members of Congress took in favor of the public option during the health care reform debate.

Talking about getting things done is “a sanctimonious talking point that fits well with what the Chronicle and big papers want to hear,” Avalos said. He said the Chronicle and other downtown interests are more interested in preserving the status quo and blocking progressive reforms. “It’s what they want to see not get done.”

Campos even challenged the comment publicly during the Jan. 11 board meeting when he said, “It’s important to get things done, but I don’t think getting things done is enough. We have to ask ourselves: what is it that we’re getting done? How is it that we’re getting things done? And for whom is it that we’re doing what we’re doing? Is it for the people, or the downtown corporate interests? I hope it’s not getting things done behind closed doors.”

Chiu said that, for him, getting things done is about expanding the progressive movement and consolidating its recent gains. “I think we all share a political goal. As progressives, we all share a political goal of getting things done and growing mainstream support for our shared progressive principles so that they really become the values of our entire city.”

To do that, he said, progressives are going to need to be more conciliatory and cooperative than they’ve been in the past. “I think it’s easy to slip into a more oppositional way of discussing progressive values, but I’m really pushing to move beyond that.”

The biggest single issue this spring will be the budget — and it’s hard to know exactly where the board president will draw his lines. “I have spoken to Mayor Lee about the need for open, transparent, and community-based budget processes and he’s open to that,” Chiu told us — and that alone would be a huge change. But the key progressive priority for the spring will be finding ways to avoid brutal budget cuts — and that means looking for new revenue.

When asked whether new general revenue will be a part of the budget solution, instead of Newsom’s Republican-style cuts-only approaches, Chiu was cautious. “I am open to considering revenues as part of the overall set of solutions to close the budget deficit,” he said. “I am willing to be one elected here that will try to make that argument.” But with his political clout and connections right now, he can do a lot more than be one person making an argument.

Chiu has always been open to new revenue solutions and even led the way in challenging the cuts-only approach to both the city budget and MTA budget two years in a row, only to back down in the end and cut a deal with Newsom. When asked whether things will be better this year given his closer relationship to Lee, Chiu replied, “I think things are going to be different in the coming months.”

During the board’s Jan. 7 deliberation on Lee, Sup. Eric Mar also said that based on his communications with Lee, Mar believed that the Mayor’s Office is open to supporting new revenue measures. He echoed the point later to us.

In addition to supporting the open, inclusive budget process, Mar called for “a humane budget that protects the safety net and services to the most vulnerable people in San Francisco is kind of the critical, top priority.

“I think it’s going to be difficult working with the different forces in the budget process,” he added. “That’s why I wish it could have been a progressive who was chairing the budget process.”

Mar said progressive activism on the budget process is needed now more than ever. “The Budget Justice Coalition from last year I think has to be reenergized so that so many groups are not competing for their own piece of the pie, but that it’s more of a for-all, share-the-pain budget with as many people communicating from outside as possible, putting the pressure on the mayor and the board to make sure that the critical safety net’s protected.”

 

CUTS WILL BE CENTER STAGE

But major cuts — and the issue of city employees pay and benefits — will also be center stage.

At the board’s Jan. 11 meeting, before the supervisors voted unanimously to nominate Lee as interim mayor, Sup. Elsbernd signaled that city workers’ retirement and health benefits will once again be at the center of the fight to balance the budget.

Elsbernd noted that in past years he was accused of exaggerating the negative impacts that city employees’ benefits have on the city’s budget. “But rather than being inflated, they were deflated,” Elsbernd said, noting that benefits will soon consume 18.14 percent of payroll and will account for 26 percent in three years.

“Does the budget deficit include this amount?” he asked.

And at the after-party that followed Lee’s swearing-in, Public Defender Jeff Adachi, who caused a furor last fall when he launched the ill-considered Measure B, which sought to reform workers’ benefits packages, told us he is not one to give up lightly.

“We learned a lot from that,” Adachi said. “This is still the huge elephant in City Hall. The city’s pension liability just went up another 1 percent, which is another $30 million”

Chu agreed that worker benefits would be a central part of the budget-balancing debate. “Any conversation about the long-term future of San Francisco’s budget has to look at the reality of where the bulk of our spending is,” she said.

Avalos noted that he plans to talk to labor and community based organizations about ways to increase city revenue. “I’m going to work behind the scene on the budget to make sure the communities are well-spoken for,” Avalos said, later adding, “But it’s hard, given that we need a two-thirds majority to pass stuff on the ballot.”

Last year, Avalos helped put two measures on the ballot to increase revenue: Prop. J, which sought to close loopholes in the city’s current hotel tax and asked visitors to pay a slightly higher hotel tax (about $3 a night) for three years, and Prop. N, the real property transfer tax that slightly increased the tax charged by the city on the sale of property worth more than $5 million.

Prop. N should raise $45 million, Avalos said. “I’ve always had my sights set on raising revenue, but making cuts is inevitable.”

 

THE IDEOLOGY ARGUMENT

Newsom and his allies loved to use “ideology” as a term of disparagement, a way to paint progressives as crazies driven by some sort of Commie-plot secret agenda. But there’s nothing wrong with ideology; Newsom’s fiscal conservative stance and his vow not to raise taxes were ideologies, too. The moderate positions some of the more centrist board members take stem from a basic ideology. Wiener, for example, told us that he thinks that in tough economic times, local government should do less but do it better. That’s a clear, consistent ideology.

For much of the past decade, the defining characteristic of the progressives on the board has been a loosely shared urban ideology supported by tenants, immigrant-rights groups, queer and labor activists, environmentalists, preservationists, supporters of public power and sunshine and foes of big corporate consolidation and economic power. Diversity and inclusiveness was part of that ideology, but it went beyond any one political interest or identity group.

It was often about fighting — against corruption and big-business hegemony and for economic and social equality. The progressive agenda started from the position that city government under Brown and Newsom had been going in the wrong direction and that substantive change was necessary. And sometimes, up against powerful mayors and their well-heeled backers, being polite and accommodating and seeking common ground didn’t work.

As outgoing Sup. Daly put it at his final meeting: “I’ve seen go-along to get along. If you want to do more than that, if you think there’s a fundamental problem with the way things are in this world, then go-along to get along doesn’t do it.” When Chiu announced that the new progressive politics is one of pragmatism, he was making a break from that ideology. He was signaling a different kind of politics. He has urged us to be optimistic about the new year — but we still don’t know what the new agenda will look like, how it will be defined, or at what point Chiu and his allies will say they’ve compromised and reached out enough and are ready to take a strong, even oppositional, stand. We do know the outcome will affect the lives of a lot of San Franciscans. And when the budget decisions start rolling down the pike, the political lines will be drawn fairly clearly. Because reaching across the aisle and working together sounds great in theory — but in practice, there is nothing even resembling a consensus on the board about how the city’s most serious problems should be resolved. And there are some ugly battles ahead.

Former Mayor Willie Brown says that choosing a person of color for a leadership position should be a progressive value. Board of Supervisors President David Chiu says the new mayor, Ed Lee, is a progressive. Several supervisors and other political observers say the six-vote progressive majority on the board is gone.

And nobody really talks about what that word means.

Progressive is a term with a long political vintage, but it’s changed (as has the political context) since the 1920s. (Progressives these days aren’t into Prohibition.) So I’m going to take a few minutes to try to sort this out.

I used to tell John Burton, the former state senator, that a progressive was a liberal who didn’t like real estate developers. But that was in the 1980s, when the Democratic Party in town was funded by Walter Shorenstein and other developers who were happy to be part of the party of Dianne Feinstein, happy to be liberals on some social issues (Shorenstein insisted that the Chamber of Commerce hire and promote more women), and happy to promote liberal candidates like John and Phil Burton for state and national office — as long as they didn’t mess with the gargantuan money machine that was high-rise office development in San Francisco.

But these days it’s not all about real estate; it’s that the level of economic inequality in the United States has risen to levels unseen since the late 1920s. So I sat down on a Saturday night when the kids went to bed(yeah, this is my social life) and made a list of what I think represent the core values of a modern American progressive. It’s a short list, and I’m sure there’s stuff I’ve left off, but it seems like a place to start.

This isn’t a litmus test list (we’ve endorsed plenty of people who don’t agree with everything on it). It’s not a purity test, it’s not a dogma, it’s not the rules of entry into any political party … it’s just a definition. My personal definition.

Because words don’t mean anything if they don’t mean anything, and progressive has become so much of a part of the San Francisco political dialogue that it’s starting to mean nothing.

For the record: when I use the word "progressive," I’m talking about people who believe:
1. That civil rights and civil liberties need to be protected for everyone, even the most unpopular people in the world. We’re for same-sex marriage, of course, and for sanctuary city and protections for immigrants who may not have documentation. We’re also in favor of basic rights for prisoners, we’re against the death penalty, and we think that even suspected terrorists should have the right to due process of law.
2. That essential public services — water, electricity, health care, broadband — should be controlled by the public, not by private corporations. That means public power and single-payer government run health insurance.
3. That the most central problem facing the city, the state, and the nation today is the dramatic upward shift of wealth and income and the resulting economic inequality. We believe that government at every level — including local government right here in San Francisco — should do everything possible to reduce that inequality. That means taxing high incomes, redistributing wealth, and using that money for public services (education, for example) that tend to help people achieve a stable middle-class lifestyle. We believe that San Francisco is a rich city, with a lot of rich people, and that if the state and federal government won’t try to tax them to pay for local services, the city should.
4. That private money has no place in elections or public policy. We support a total ban on private campaign contributions, for politicians and ballot measures, and support public financing for all elections. Corruption — even the appearance of corruption — taints the entire public sector and helps the fans of privatization, and progressives especially need to understand that.
5. That the right to private property needs to be tempered by the needs of society. That means you can’t just put up a highrise building anywhere you want in San Francisco, of course, but it also means that the rights of tenants to have stable places for themselves and their families to live is more important than the rights of landlords to maximize return on their property. That’s why we support strict environmental protections, even when they hurt private interests, and why be believe in rent control, including rent control on vacant property, and eviction protections and restrictions on condo conversions. We think community matters more than wealth, and that poor people have a place in San Francisco too — and if the wealthier classes have to have less so the city can have socioeconomic diversity, that’s a small price to pay. We believe that public space belongs to the public and shouldn’t be handed over to private interests. We believe that everyone, including homeless people, has the right to use public space.
6. That there are almost no circumstances where the government should do anything in secret.
7. That progressive elected officials should use their resources and political capital to help elect other progressives — and should recognize that sometimes the movement is more important that personal ambitions.

I don’t know if Ed Lee fits my definition of a progressive. He hasn’t taken a public position on any major issues in 20 years. We won’t know until we see his budget plans and learn whether he thinks the city should follow Gavin Newsom’s approach of avoiding tax increases and simply cutting services again. We won’t know until he decides what to tell the new police chief about enforcing the sit-lie law. We won’t know until we see whether he keeps Newsom’s staff in place or brings in some senior people with progressive values.
I agree that having an Asian mayor in San Francisco is a very big deal, a historic moment — and as Lee takes over, I will be waiting, and hoping, to be surprised.

Judge Kopp to run for D.A.?

Yep: Quentin Kopp, the 82-year-old former supervisor, former state Senator, retired Superior Court judge and political fixture in this city for four decades, is being talked about as a potential challenger to the new district attorney, George Gascon.


I just talked to Kopp, and he confirmed that a lot of people have approached him about running in November, and while he’s not a candidate at this point, he hasn’t ruled it out. “If I do run — and I have to think about the rigors of a campaign — I would run on a platform of using the district attorney’s office to root out political corruption,” he said.


Kopp has always been fairly conservative on law-and-order issues and is a supporter of the death penalty. His political base has always been on the West side of town. But in a typically untraditional fashion, Kopp has become a bit more liberal in his later years — and has always been a strong supporter of open government and a foe of political sleaze.


And he seems to be in good health and certainly hasn’t lost his political vigor. (And, he reminds me, the legendary DA of New York, Robert Morgenthau, served past his 90th birthday.) So Kopp would be a formidable candidate in what’s shaping up to be a fairly large field.


Never a dull moment in this town.

Going commando

CHEESY, SLEAZY CINEMA Last year found Jack Abramoff a peculiarly hot commodity at the movies, especially if you consider he spent most of the year in federal prison and hadn’t exercised his own Hollywood ambitions in nearly a quarter-century.

But then his recent on-screen exposure was not of an ilk he’d have chosen for himself: as subject of a documentary (2010’s Casino Jack and the United States of Money) and biographical drama (plain Casino Jack, also 2010) both depicting the now-infamous Washington, D.C., lobbyist as personification of that Shrub Era conservative jingoism, corrupt backdoor business deals, egomania, and greed that helped land us in our current economic craphole. And which got him four years, ending last month even as former Republican House Majority leader and BFF Tom DeLay faced the start of his own money-laundering slammer stint.

Abramoff was not likely to have enjoyed either portrait, not even as semi-sympathetically (albeit poorly) portrayed by Academy Award-winning thespian Kevin Spacey in the weaker film. If he’d been able to invent his own starring vehicle, no doubt it would have been more a flatteringly bold cross of 1987’s Wall Street (the Michael Douglas part), 1960’s Exodus (the Paul Newman as he-man crusader for Israel part) and 1980s Rocky-Rambo Stallone (the whole enchilada, from bulging biceps to rippling Old Glory and Commie-wasting weaponry). In the Reagan America of his physical if not yet political prime, he really was a bit of all those things: bodybuilder, Zionist, rabid anti-Red.

Whether he ever harbored dreams of being a celluloid hero, or was always content to become a real-life Supermensch, Abramoff did once make a movie — exactly one — exemplifying his beliefs and self-image in suitably cartoonish fashion, before realizing Hollywood’s corridors of power were puny game for a real man. So he moved on to the more hallowed halls of D.C. and Manhattan. But first, there was Red Scorpion.

This 1988 actioner starred 6-foot, 5-inch Swedish meatball Dolph Lundgren, hot from playing the robo-Russkie villain in Rocky IV (1985) and He-Man in Masters of the Universe (1987), as a “perfect killing machine” sent by evil Soviet commanders to assassinate a resistance leader in a fictive African nation under the thumb of Communist oppressors.

Tending not to play well with others, Lt. Nikolai Rachenko spends his first night here in jail for “disorderly conduct” — after a few drinks he’d kicked open a saloon door, beat up half the patrons, and machine-gunned the joint. Boys will be boys. He shares a cell with a local freedom fighter (Al White) and an American reporter (M. Emmet Walsh at his formidably most-obnoxious). For no obvious reason our steroid miracle of a KGB enforcer decides moments later to switch sides and help them escape. This effort requires killing about a million extras playing Russian and Cuban military occupiers to the tune of Little Richard’s “Good Golly Miss Molly.” (Because nothing says “Democracy rocks!” like the orgasmic trills of an African American queen.)

Slowly-dawning ability to feel empathy for suffering peoples indicated by the heavings of his perpetually oiled torso and completely unintelligible mutterings, Nikolai is recaptured by former masters and made to endure homoerotic torture. He escapes again, staggering through the desert alone, shirtless and shiny. Bushmen rescuers teach this Golden Bwana something or other — like Billy Jack, he sweats, grunts, and hallucinates toward enlightenment — and give him a scorpion tattoo as diploma.

Now armed spiritually as well as abdominally to do good, his reappearance in civilization spurs Walsh to call this juiced Russki “the gutsiest goddamn sonuvabitch I ever met.” (Arne Olsen’s screenplay, from the brothers Jack and Robert Abramoff’s story idea, is seldom even this articulate.)

The climactic triumphant popular uprising at one point hinges on Lundgren lifting a truck out of a sandtrap with his bare bulging guns, a bit included purportedly because Jack Abramoff was an iron-pumping addict himself at the time. (What makes the scene funnier is that it evidently occurred to no one that Nikolai’s load would be lightened if Walsh got his fat ass out of the truck cab for a minute.)

A movie rife with bad dialogue badly spoken — you’ll gulp as White seemingly enthuses “When we arrive there will be a celebration and much fisting!” — ends aptly with the worst pronunciation ever of “Fucken’ A.” Our heroes are then freeze-framed while strolling over another umpteen freshly killed Commies.

Red Scorpion was shrugged off as what it basically was, yet another Rambo ripoff arriving toward the tail end of that subgenre’s lifespan. (A theatrical flop, it did well enough on tape and cable to prompt 1994’s in-name-only sequel Red Scorpion 2, on which the Abramoffs got executive producer credits.) There certainly are more cheap, inept, laughable, senseless, just plain dumb films of its ilk — though this one does excel at dumbness — and unlike many it does have one good joke, involving a grenade and a decapitated hand. Otherwise, if not for its primary motivator’s subsequent antics, Red Scorpion would be just another forgotten B-grade cultural relic.

But the Beverly Hills-raised Abramoff — who spent the earlier part of the 1980s as an aggressive far-right youth activist — intended this first-last cinematic venture as a stealth combo of dynamite popular entertainment and anti-Red Menace propaganda. He modeled the character of “Mombaka’s” resistance savior Sundata (played by Ruben Nthodi) on real-life Angolan anti-Marxist rebel warlord Jonas Savimbi, a darling of later Cold War hawks. (Others would soon call him “a charismatic homicidal maniac.”)

It is still debated whether Red Scorpion‘s $16 million budget was secretly funded primarily by the South African government and/or military. Abramoff denies it — though he had already spearheaded support of the apartheid regime as College Republican National Committee chairman and founder of the dubiously named think tank, International Freedom Foundation. In any case, once protestors got wind of the production shooting in South Africa-controlled Namibia — defying an international boycott — a skittish Warner Bros. pulled out as distributor. (Scorpion was then picked up in the U.S. by Shapiro-Glickenhaus, who later gave us 1990’s Frankenhooker and 1992’s Basket Case 3: The Progeny.)

The shoot was fraught. Some actors and crew complained they were never paid; production was suspended for three months when money ran out; star attraction Lundgren was apparently quite the hulking handful on and off set. Afterward, Abramoff — who’d converted to Orthodox Judaism at age 12 after seeing Fiddler on the Roof (1971) — blamed the film’s potty-mouthed and violent excesses on director Joseph Zito (of future Tea Party fan Chuck Norris’ own 1985 anti-Commie classic Invasion U.S.A.) He founded something called the Committee For Traditional Jewish Values in Entertainment as penance.

That noble latter endeavor was abandoned about five seconds later, however, since by then Abramoff realized he had better things to do than mess around with pansy-ass showbiz. Among his future, better-known achievements — the ones that got him top billing as Inmate 27593-112 — were bilking casino-owning Native American tribes, keeping third world factory sweatshops safe from investigation, pimping Congress to myriad corporations, and otherwise pedaling corruption ’round the globe, all while clutching family values and raving against the Godforsaken liberals. He was ever so righteous about doing wrong.

Today, he’s free, if uncharacteristically silent, having finished both his hoosegow stint and a halfway-house stay during which he worked for below minimum wage at a Baltimore kosher pizzaria. One suspects he will not be flippin’ pie in the future, however. Sibling Robert Abramoff is still in the biz, producing such fascinating-sounding recent projects as 2009’s Pauly Shore and Friends, 2009’s Jesus People: The Movie, and 2010’s Dino Mom.

Lundgren, recently looking fine (if downsized) in 2010’s all-star Expendables, now directs his own direct-to-DVD action vehicles. Still fighting the good fight, alongside Israeli special forces and South African mercenaries, Savimbi died in a hail of machine-gun fire eight years ago. That event helped end Angola’s civil war after nearly three decades. And Red Scorpion lives on, more or less. I found my used VHS copy at Rasputin Music for 50 cents. Fucken’ A!
