The self-appointed censors at GoDaddy

TECHSPLOITATION On the morning of Jan. 24, Fyodor Vaskovich awoke to discover that his Web site, SecLists.org, had been transformed into a giant error message. The message said his domain couldn’t be resolved. This troubled him greatly: SecLists is an archive of several computer security–related mailing lists that contains more than 50,000 pages of technical information. It has thousands of visitors per day and nets Vaskovich a fair amount of income from Google ads. Where had the site gone? He checked with the registrar that sold him his site, GoDaddy, and discovered the megacorporation had changed the site’s name servers — addresses that tell your browser how to find the place where a Web site is hosted. Instead of his Web host’s name servers, he found this name server: ns1.suspended-for.spam-and-abuse.com

What the hell? Vaskovich checked his answering machine and found a message from somebody in the abuse department at GoDaddy telling him they were going to pull the plug on his domain. Based on his logs, it appeared that his name servers had been changed less than a minute after the call was made. Essentially, he’d been given a few seconds’ notice before a major Internet resource (and source of revenue) was shut down.

For the rest of the day Vaskovich was on the phone with GoDaddy trying to untangle what had happened. Luckily, he kept careful records. These records corroborated his story that he’d been given less than a minute’s notice and that GoDaddy repeatedly refused to give him customer service for several hours. At last he learned that SecLists had been yanked offline because MySpace contacted GoDaddy and requested it. One of the 50,000 pages on SecLists contained an e-mail in which somebody had listed the names and passwords of several MySpace users. Instead of asking Vaskovich to take down the page with passwords — which is standard industry practice — MySpace asked GoDaddy to squash the whole site. GoDaddy should have contacted Vaskovich first, and they could have asked for a legal takedown notice. But they didn’t.

What makes GoDaddy’s actions even more disgusting is that the passwords in question had been leaked about 10 days before GoDaddy took SecLists down. They appeared on dozens of other security-related and hacker Web sites. Security expert Bruce Schneier had even written a column in which he analyzed the quality of about 30,000 of the leaked passwords. (Among the top 10 popular passwords was "fuckyou," which completely mirrors my feelings for MySpace.)

So the point is passwords were already circuutf8g, and MySpace needed to tell its customers to change their passwords. Squelching SecLists wasn’t going to protect anyone. And yet GoDaddy’s general counsel, Christine Jones, defended its actions because she believed pedophiles would get access to children’s names and passwords. "For something that has safety implications like that, we take it really seriously," she told Wired News editor Kevin Poulsen. "I think the fact that we gave him notice at all was pretty generous."

Writing in his blog about the incident, Poulsen added, "Every link in internet service — network operators, hosting companies, and now domain registrars — willing to take on a censorship role increases the likelihood of legitimate content being suppressed." What this GoDaddy disaster makes clear is that instant censorship is possible, with no court oversight, at almost any point in the data chain. And for users who aren’t as savvy or well-connected as Vaskovich, getting shut down by GoDaddy would be essentially a death sentence for speech. Indeed, he told me that he couldn’t get any service from GoDaddy until he told their customer service rep that he spends thousands of dollars on domains with the company every month. Suddenly, he was told his two-day wait for service would be cut down to mere minutes.

In the short term, what this means is do not use GoDaddy as your registrar. Vaskovich has set up a protest site at NoDaddy.com, where you can learn more.

A spokesperson from GoDaddy said the company disagrees with the way Vaskovich characterized his experience. While the legal department at GoDaddy has not yet read the NoDaddy site, the spokesperson said the company will take legal action if any of its statements are untrue. Given that GoDaddy disputes Vaskovich’s story, such a suit seems inevitable. *

The search for Spocko

For the better part of a year starting in late 2005, San Francisco blogger Mr. Spocko waged a quiet campaign against right-wing talk radio station KSFO, 560 AM. He wrote to its sponsors and played for them explicit portions of the station’s programming, such as shock jock Lee Rodgers’s call for antiwar protesters to be "stomped to death … just stomp their bleeping guts out."

The idea was to educate corporations about exactly what they were sponsoring, in the hope that Spocko’s work might staunch the free flow of hateful rhetoric. He also posted these audio clips on his blog, Spocko’s Brain. Several advertisers pulled their ads as a result of his campaign. But after MasterCard decided to cancel its KSFO spots in July 2006, Spocko said hostile commenters started to arrive on his blog and declare that he was in legal jeopardy.

"They said things like ‘They’re going to find you and sue you for everything you’ve got,’ " Spocko told the Guardian by telephone, the only way he will be interviewed because of fears for his personal safety if people learn his true identity.

Spocko suspected people at the station were behind the threats and forged on with his campaign. Then, on Dec. 22, 2006, lawyers for KSFO’s parent company, ABC — a division of Disney — sent Spocko’s Internet hosting company a cease and desist letter. The letter asserted Spocko’s clips of KSFO content were copyrighted material and demanded they be taken down from his site immediately. 1&1 Internet, the hosting company, not only complied but went one step further. It shut down Spocko’s Brain.

That’s when things got crazy.

Mike Stark — a bare-knuckle liberal blogger who famously asked Sen. George Allen, the Virginia Republican who was ousted in the last election, if he ever spat on his wife — took up Spocko’s cause. Within days scores of like-minded bloggers had posted the KSFO audio clips on their own blogs, essentially daring Disney to come after all of them. By the first week of the new year, the mainstream media — including USA Today, the San Francisco Chronicle, and the New York Times — had gotten hold of the story.

Spocko’s battle against KSFO took on the dimensions of a media turf war, with the right’s traditional ally, talk radio, pitted against the new and largely left-wing online media. Spocko was suddenly and reluctantly famous, despite the fact that few actually know who he is. KSFO and Disney "made me a public figure," he told us. "[Now] in their mind I’m fair game."

Spocko cites right-wing hit pieces — such as the book KSFO’s Melanie Morgan wrote about Cindy Sheehan, American Mourning — as examples of what happens to lefties who stick their necks onto the conservative-media chopping block. But he also fears something much worse than character assassination. He passed along an e-mail in which someone said he "sounds like a terrorist." Morgan and her fellow KSFO hosts regularly advocate harsh treatment for terrorists, to put it mildly.

"Morgan has told her one million members in Move America Forward [a pro–war on terror ‘charitable’ organization that Morgan chairs] and all her listeners that I’ve smeared her, I’ve attacked her, I’ve threatened her security," he told us. "That’s scary as hell."

Despite his professed fears, Spocko has held his ground. On Jan. 25 his lawyer, Matt Zimmerman, sent ABC a strongly worded letter demanding that it officially retract its cease and desist letter to Spocko’s old hosting company. Zimmerman works at the Electronic Frontier Foundation (EFF), which fights for people’s online freedom.

"[ABC-Disney] were clearly in the wrong here," Zimmerman told us. "They shouldn’t be in the habit of sending out baseless threats without following through on them."

At issue is whether Spocko’s posting of KSFO’s content constitutes what is known as fair use, an aspect of US copyright law that allows for certain limited usage of protected materials. Zimmerman’s letter to ABC goes through the standard four-point criteria for testing fair use. But more important, Zimmerman and Spocko say Disney did not even bother to follow the correct procedure for removing copyrighted material from a Web site.

The Digital Millennium Copyright Act of 1998 established a protocol for corporations to follow when they believe their materials have been poached. According to Zimmerman, however, Disney did not cite the DMCA in its letter to 1&1 Internet. Disney simply threatened 1&1 with unspecified legal action if it did not take down Spocko’s clips, and 1&1 caved.

"If they were serious about their beliefs that this was a copyright infringement, they could have sent a takedown notice" as specified in the DMCA, Zimmerman said. "But they didn’t do that."

Spocko’s lawyer also had some choice words for 1&1, the hosting company. Under the DMCA, Internet service providers are protected from liability, so long as they too follow proper protocol under the act. But because Disney did not cite the DMCA, Zimmerman said, 1&1 was not in any legal peril. The company "was under no obligation" to pull Spocko’s blog, he asserted. "People should be aware that in this case [1&1] decided that their own interests were more important than their customer’s."

Neil Simpkins, a 1&1 spokesperson, told the Guardian, "We are not a judicial system here. [This] issue is between Spocko and whoever is the owner of the copyright." When asked if 1&1 had consulted with legal counsel of any kind before pulling the blog, Simpkins answered that it had. But when asked for the names and contact information of his company’s legal advisers, Simpkins didn’t provide them. Officials at KSFO and ABC refused to comment for this story.

With the help of the EFF and his blogger allies, Spocko has found another ISP. Computer Tyme Web Hosting now carries his blog, which is back up and running. Some Spocko’s Brain readers have continued the campaign against KSFO. According to the blog, one Spocko devotee got the California state affiliate of the Automobile Association of America to pull its ads from the station.

But Spocko hasn’t yet posted any new audio clips nor has he contacted any advertisers since his run-in with KSFO’s parent companies. Spocko is conflicted. Part of him wants to jump back into the fray. But after the media maelstrom last month, he’s holding back, at least until ABC and Disney respond to his lawyer’s letter.

"I need to pay attention to what’s right, [but] I also need to pay attention to the real world," he said. "Media conglomerates can be ruthless."

Despite his newfound circumspection, he still believes KSFO and its fans will come after him. He even speaks of the outing of his true identity as a foregone conclusion.

"After my 15 minutes [of fame] are over — and I’m at 14:58 right now — they’ll still be out there, and they’ll still be pissed off," Spocko said. "And after they out me, I don’t know how this is going to impact me." *

The straight story on the armory

The sale of the former National Guard armory on Mission Street has caused a flurry of concern about the plans for the site of the new owner and developer, Kink.com. Most of the columns and editorials in the San Francisco Chronicle, Examiner, and BeyondChron.com have been reactionary and politically opportunistic. It has given the cheerleaders of runaway market-rate development a new reason to knock affordable housing advocates in general and the Mission Anti-Displacement Coalition in particular.

For the past six years, MAC, with the participation of hundreds of Mission District residents, has been developing a vision for the neighborhood, called the People’s Plan, which confronts the gentrification pressures of new development and sets out policies for a healthy, sustainable community. Our approach is not that of knee-jerk NIMBYs mindlessly opposing any proposed change in our community. We are in favor of affordable housing, good-paying jobs for immigrants and working-class families, and sustainable economic development.

However, immediately after the Kink.com story broke, writers such as Ken Garcia blamed MAC for directly causing the sale to what other papers are calling a “porn production company.” It’s true that MAC has opposed the previous three development proposals, but the developers themselves, responding to the ups and downs of the market, ultimately dropped the projects for financial reasons. Here’s a brief review:

In 2000 a multimedia office complex proposal was approved by the Planning Department and later dropped. The armory was then going to be a server farm. The server farm was approved by the Planning Department again (contrary to what Garcia has written), but the company went under. A local financier retained control and proposed an outlandish and financially risky housing proposal.

The luxury housing proposal went into the planning process, and an environmental review had begun, but instead, the owner sold the site to Kink.com

MAC didn’t know the owner was secretly negotiating the sale of the armory. Had the financiers been honest with the community, perhaps the city or some other entity could have come forward and put the armory to better use. But at this point, the sale of the armory is complete, and there’s no further process necessary for the new owners to set up shop. That means it’s difficult for the community or city to stop the proposed use.

Now the community finds itself responding to this purchase and to opportunists who are taking advantage of this situation to use the current plan as a wedge issue to attack MAC and other affordable housing activists who have had concerns about high-end market-rate housing development in the Mission. The Mission is both the heart of the Latino community in San Francisco and home to other communities. For a healthy and sustainable community, a measuring stick for a development project is whether it will lead to displacement of residents and community-serving businesses and contribute to gentrification.

MAC will continue to fight for equitable development through the People’s Plan and the Mission rezoning process and will continue to challenge all projects that have the potential to negatively impact our community. *

Records unsealed in a federal civil suit last week show that the Hearst Corp. and MediaNews Group have grown intensely fond of each other during the past several years. Hearst even considered selling its San Francisco Chronicle to MediaNews in 2005, but CEO Dean Singleton wasn’t offering nearly enough money.

What the records don’t show is any effort by the two chains to compete in the market by improving their products.

The Guardian first posted a story online Jan. 31 detailing court documents unsealed by Federal Judge Susan Illston in real estate investor Clint Reilly’s antitrust suit against Hearst, MediaNews, and a group of other newspaper companies who joined Singleton in a Northern California partnership that has given him control of almost every big daily in the Bay Area except the Chronicle.

The evidence of anticompetitive behavior is so clear now that the obvious question is whether the US Justice Department or the California Attorney General’s Office, with new boss Jerry Brown, will do anything about it.

Gina Talamona, a Justice Department spokesperson in Washington, DC, confirmed that the feds were still looking into Hearst’s alliance with MediaNews, but she wouldn’t, of course, divulge details.

"I’m just confirming generally we’re looking at it, and we look at the anticompetitive effects of a proposed transaction, and that’s ongoing," Talamona said. "Obviously, our folks are aware of what’s going on in that private suit, but I wouldn’t have anything further for you on that."

Illston, meanwhile, has made it clear in the past that she could force MediaNews to give up some of its newly purchased properties if Reilly convinces her that the deal violates antitrust laws.

Among the documents we obtained is a deposition of Hearst senior vice president James Asher, taken by Justice Department lawyers last September, in which he candidly explains how Hearst for years has wanted to invest in MediaNews — which likes to buy up all the papers in a region and cut costs by sharing facilities and stories.

Hearst executives "formed a favorable impression of Dean Singleton and his company" all the way back in 1995, when a shady deal in Houston gave Hearst’s Houston Chronicle a dominant position in that market after MediaNews shuttered the Houston Post and sold its assets to Hearst. Since then, Asher stated, Hearst has quietly waited for an opportunity to invest in MediaNews or at least cut costs by joining ad, distribution, and printing operations with the ostensible competitors across the bay.

That opportunity arose when Hearst claims it was most needed.

Hearst spent three-quarters of a billion dollars buying the San Francisco Chronicle in 2000, a messy deal that nearly left its old property, the San Francisco Examiner, in shambles. But the purchase quickly became a drag on the company’s portfolio.

Hearst has since lost $330 million trying to figure out how to make the Chronicle profitable. Of all the documents reviewed by Guardian so far, which include memos between Hearst and MediaNews executives outlining potential collaborations, little time appears to have been spent determining how the product itself could actually be made more valuable to readers and, hence, more lucrative for both companies. Instead, Hearst seemed hungry to emulate Singleton or at least buy a bunch of his stock and let him handle the dirty work.

The infamous Singleton strategy includes clustering properties (its Bay Area cluster is now the company’s largest), slashing staff, outsourcing jobs, and consolidating business offices. Layoffs have already occurred at the San Jose Mercury News and the Contra Costa Times, and reporters are covering stories for several papers under a single "MediaNews Staff" byline.

While Hearst lawyers told Illston early in Reilly’s suit that its $300 million investment in MediaNews, consummated last summer, would involve only non–Bay Area properties to avoid conflicting interests, executives were telling another story behind the scenes.

"The proposed transaction is an opportunity to invest at a reasonable price in a company we have admired," Hearst president and CEO Victor Ganzi wrote to Hearst’s board of directors last July. "If we are able to convert the investment to common stock in all of MediaNews, we will be able to participate in the efficiencies MediaNews will achieve through the consolidation of the Bay Area newspapers other than the San Francisco Chronicle. Whether or not we are able to convert our investment, the proposed transaction provides additional impetus for lawful cooperation between the San Francisco Chronicle and the Bay Area newspapers, which will be owned or controlled by MediaNews, in areas such as distribution, national advertising and the Internet."

Several hundred pages of records were originally filed under seal in Reilly’s suit, but the Guardian, along with the East Bay nonprofit Media Alliance, intervened to have the filings opened to public access. Attorneys Jim Wheaton, David Green, and Pondra Perkins of the First Amendment Project did the legal work.

Illston agreed with our request and made most of the records available in an order last month. Reilly’s suit is expected to go to trial in the spring. He’s alleging that Hearst, MediaNews, and its other business partners, including the Stephens Group and Gannett Co., conspired to divide and monopolize the Bay Area newspaper market.

At the very least, Asher admitted in his deposition that Hearst saw media consolidation as one of the few reasons to bother staying in the newspaper biz. Originally, Hearst executives were considering a $500 million investment in MediaNews, but that amount was eventually lowered.

"We’re among the larger owners and operators of newspapers," Asher stated. "We still believe in them, notwithstanding their challenges, and we would like to participate in that consolidation. And, in fact, if we don’t choose to, we should probably think about exiting the business." *

The benefits of fiber

Amsterdam is building a citywide fiber-to-the-premises system. So are Hong Kong, Milan, and Zurich. If San Francisco follows suit, it would be making a far-sighted, multifaceted investment: FTTP would boost our economy, attracting software companies, video production houses, and digital media shops. It would enhance public health, allowing surgeons to review the same materials from different locations. Municipal fiber would improve public safety, facilitating the mirroring and backup of vital data at remote, earthquake-safe locations. It would enable unlimited and open communications — breaking ongoing communication monopolies — and save buckets of cash within a couple of decades.

These futuristic findings are laid out in the fiber feasibility report Sup. Tom Ammiano commissioned two years ago, but the Department of Telecommunications and Information Services didn’t green-light it until last fall. As a result of this delay, the city’s Maryland-based consultant, Columbia Telecommunications Corp. (CTC), couldn’t complete its fiber study until after Mayor Gavin Newsom said he’d struck a wi-fi deal with the Google-EarthLink partnership that still requires the Board of Supervisors’ approval.

Newsom’s plan was threatened even before his recent scandals. City budget analyst Harvey Rose’s report on municipal wi-fi offered a scathing assessment of the Google-EarthLink deal. Board members will now weigh the two new reports — and the opinions of a growing number of critics of the deal — before deciding on the mayor’s wi-fi proposal.

"So far I have more questions than answers," Sup. Aaron Peskin said of trying to digest the budget analyst’s report. "Questions about free service and quality of service. Questions about the environmental and aesthetic impacts of installing antennas citywide. I’ve got questions about Google’s cooperation with a totalitarian government overseas. I’ve got questions reutf8g to the shitty service I’ve personally gotten from EarthLink. Questions about the municipalization of services and questions about other technologies, including fiber."

Peskin admitted he’s yet to read the fiber report, which lauds FTTP as "the holy grail of broadband" while explaining that wi-fi isn’t a competitor but a complement to fiber, since wi-fi’s key advantage is its "mobility and connectivity during movement."

That said, the report recommends building citywide fiber, which it describes as a "fat pipe all the way into the home or business." In the face of the public sector’s lack of interest in building fiber networks that would meet growing demands for bandwidth and speed in an equitable and affordable manner, the CTC report concludes that municipal fiber would rank San Francisco among the world’s most far-sighted cities "by creating an infrastructure asset with a lifetime of decades that is almost endlessly upgradeable and capable of supporting any number of public or private sector communications initiatives."

With fiber allowing numerous competitors to quickly and inexpensively enter the market and offer competing, differentiated broadband services and access, the report recommends a wholesale open-access model to facilitate "democratic and free market values" and enhance the city’s reputation "for visionary and pioneering projects."

The report estimates a citywide open-access wholesale model will cost $563 million but predicts it will spark economic investment and jobs. It recommends building a pilot network in a 12-square-mile economic development area that includes Bayview, Hunters Point, South Bayshore, Chinatown, the Mission District, Mission Bay, Potrero Hill, SoMa, the Tenderloin, and the Western Addition.

The study also observes that aside from supporting safety and communications systems (thereby saving the city huge and unending costs of leasing circuits from telephone companies) and providing higher quality, higher capacity, more reliable, securer service, fiber is the best backbone for wi-fi systems.

Or as communications activist Bruce Wolfe recently told the Guardian, "Wi-fi is a parasite looking for a wire."

Speaking to us, along with United Layer’s Tim Pozar, SFLan’s Ralf Muehlen, and Our City’s Eric Brooks, Wolfe stated that far from being "the naysayers, as we were accused after critiquing the Google-EarthLink deal, we’re actually the truthsayers."

The foursome, who are supporters and providers of current wi-fi services in San Francisco, said although wi-fi rocks when you’re at an outdoor café or checking bus schedules with a cell phone, fiber rules when you’re in a basement, on a fourth floor, or in need of reliable and efficient service or massive capacity.

"That’s why it makes more sense to roll out a joint fiber-cable-wi-fi system, because all the interference and bog downs would be solved by hooking antennas into fiber," Pozar says. "Putting a bunch of antennas up as a cloud over the city supposedly gives free users speeds of 300 kbps, but anyone making a phone call or downloading a video will drain everyone else’s speeds, and blanketing the city with transmitters will make the spectrum unusable by others."

Muehlen expects the wi-fi service his business provides to get "blown out of the ether, technically, or be severely compromised," by the proposed Google-EarthLink deal. "But I wouldn’t mind if I got a network that didn’t suck," he says. "I just want something that works."

Brooks said many people who can’t afford the Internet are "compartmentalized in lower-income areas. Why not begin by addressing those areas instead of giving away the whole 49 square miles to Google-EarthLink?"

He noted that it will cost Google-EarthLink an estimated $300,000 to pay into the city-run Digital Inclusionary Fund. "That’s a drop in the bucket in terms of providing residents with gear, training, and support that truly bridge the digital divide." *

It’s been almost a week. The Guardian has moved on — to our annual sex issue.

And now Gavin Newsom is seeking "treatment" (which sounds like a lot more than it apparently is) for alcohol abuse, and he wants everything to go back to normal. But as we report in "More Than the Affair," this page, normal at Newsom’s City Hall isn’t much to be proud of. And in the meantime, a lot of damage is done — and not just (or even primarily) to the mayor’s career.

When it comes to the sex scandal, Newsom made his own bed. And I wish him well in his battle with alcohol — I know how tough that can be. But there’s another point here. Newsom is more than just a politician. He’s more than the mayor of San Francisco. He’s become a national symbol, particularly for same-sex marriage, and his reputation as an honest, ethical guy, a young rising star in the Democratic Party — and yeah, an Irish Catholic — has helped that cause.

The Ruby Tourk affair may well have been consensual, and if so, we can let it lie. But it undermines the one really good thing Newsom has done. Predictably, the right wing is having a field day: the mayor of San Francisco loves gay marriage, but he doesn’t respect traditional marriage. It’s a stupid line, but it hurts. And Newsom’s weak, simpering apology doesn’t help San Francisco or any of our shared causes either. He just looks like a loser.

I have to say: drinking or no drinking, the guy just isn’t mature enough to be in room 200.

Yeah, Willie Brown went out with younger women and impregnated a campaign fundraiser, and nobody cared. That was in part because he didn’t screw city employees who reported to him and in part because he knew how to handle the press, but it was also in part because, by the time he was mayor, Brown didn’t stand for anything. He was a political wheeler and dealer; there weren’t many people who had invested hopes and dreams in him.

Newsom took on that role a few years ago, and when you do that, the disappointments are that much bitterer. *

Brown must fight the media monopoly

EDITORIAL The evidence is now clear and compelling: the two biggest newspaper chains in the Bay Area have been plotting for years to eliminate local competition. The details that have come out of the Clint Reilly lawsuit point to almost textbook antitrust violations, the exact sort of behavior that state and federal laws prohibit. (See "What We Know Now," page 13.)

The public had no knowledge of how MediaNews Group and the Hearst Corp. were conspiring to join ad sales and distribution deals. But the federal and state regulators knew all about it; the records show that Hearst executives laid out the entire plan back in early 2006.

And yet the deal that allowed MediaNews to buy up every major daily in the region except the San Francisco Chronicle won approval from both the California and the US attorneys general — in part on the grounds that Hearst’s Chronicle would remain as a serious competitor in the market.

Which leads to some pretty obvious questions: What were the investigators and lawyers in Sacramento and Washington, DC, doing? And now that this is all out in public, will California’s new attorney general, Jerry Brown, put a stop to it?

When the McClatchy company sold the Contra Costa Times and the San Jose Mercury News to Dean Singleton, who already owned the Oakland Tribune and the Marin Independent Journal, critics immediately began to cry foul. Singleton’s strategy has always been to buy up adjoining media properties, combine as many of their assets as possible, share reporters and stories, and improve the bottom line through deep cuts. Suddenly, instead of four reporters covering events in the Bay Area, there would be just one, with one perspective and one story running in all four papers.

The same would go for advertising — instead of having several options in the region, businesses could wind up having to deal with one centralized agency that sets prices and sells ads for all four big dailies (and a bunch of smaller ones that Singleton also owns).

Still, the federal and state regulators declined to challenge or block the deal. If Reilly hadn’t sued to stop it, the machinery would already be in motion for what could be a single company, or a partnership that operates like a single company, controlling all of the daily newspapers from San Jose to Marin County, from San Francisco to Contra Costa County.

But now this is all open and visible. We don’t have much faith in the Bush Justice Department, but the new California attorney general has a history (at some moments) of showing the willingness to stand up to powerful interests and take strong political stands. This is his first and perhaps most important test. Brown needs to go into court immediately and file to block the entire deal. *

EDITORIAL OK: let’s put this all in perspective.

Gavin Newsom did something almost unbelievably, incalculably stupid. He’s in a lot of political and possibly legal trouble.

He has just admitted to having a drinking problem and is going to seek "treatment" — although it’s not clear at all what that means, except that he won’t be entering a residential center.

The heart of the scandal was just an affair — yes, an affair with a subordinate, which is a real problem (and something most of corporate America put an end to 20 years ago) — but nobody’s dead, he hasn’t started a war, the city isn’t about to collapse, and the world will keep turning. It seemed silly to us to call on Newsom to resign over that, just as it was silly for the Republicans to impeach Bill Clinton over an Oval Office blow job.

But there’s a much bigger problem here.

For months, long before this tawdry story made the front pages, it’s been clear that the mayor of San Francisco isn’t focused on the job. For whatever reason (and there may be many), Newsom has been checked out for quite some time now. As we reported in "Mayor Chicken" (1/10/07), he never attends public events that haven’t been carefully scripted. His relations with the Board of Supervisors are damaged beyond repair. He’s offering absolutely nothing in the way of leadership on the murder epidemic, the housing crisis, Muni’s meltdown, or much of anything else. He’s had plenty of time for glamour and glitz, movie stars, rides on the Google corporate jet, and the glitterati at Davos, Switzerland — but not much energy for the gritty reality on the streets of his city.

He is, we noted in our Jan. 10 cover story, "the imperious press release mayor, smiling for the cameras, quick with his sound bites, and utterly unwilling to engage in any public discussion whose outcome isn’t established in advance."

And whether we like it or not, this latest "lapse in judgment" — and Newsom’s embarrassing failure to deal with it properly — is only going to make things worse.

To be blunt, for a lot of reasons that have little to do with this tabloid sensation, we don’t see how Newsom can effectively run San Francisco for another four years. The mayor’s latest mess isn’t a scandal as much as a symptom of his shaky grip on the frighteningly tricky world of high-stakes politics. He’s acting like a dizzy kid at a rock star party who doesn’t have the maturity to handle what’s coming at him. Even his close allies have warned us that the wheels are coming off his administration. It’s not even clear that he wants to be mayor.

We wish Newsom well in his battle with alcoholism. But for the good of the city (and the causes he claims to care about), he’d be better off announcing he isn’t going to run for reelection now.

That wouldn’t be the end of his political career — plenty of people (John Burton comes to mind) have taken some time off from politics to deal with their personal lives and come back much stronger. It might be the best thing Newsom could do for himself.

Newsom says right now that he’s staying in the race, but he’s clearly wounded; that air of political invulnerability has taken a hit. When a local politician is looking bloodied, the sharks typically start to circle. That hasn’t happened yet; if anything, over the past few days, the highest-profile potential contenders have been pretty quiet about taking Newsom on.

But somebody has to do it. That’s never been clearer.

Running for mayor is serious business, and if there’s going to be a strong candidate challenging Newsom on the issues, the left needs to think about who it ought to be. Who has the experience and skills to take on the campaign? Who can appeal to a wide enough group of voters to win? Who has the sort of record and platform that progressives can support and unite around?

Those discussions need to start soon. But they need to be deliberate and thoughtful. Newsom’s political (and yes, personal) failures have given progressives an opening. There’s a chance to elect a mayor who really represents San Francisco values in deeds as well as words. Let’s take it seriously. *

Doin’ the ‘Dance

Sundance has become a spectator business event, like the weekly box office returns. This year turned out to be a surprise bull market when the same buyers who went in saying there was little of apparent commercial appeal on the program wound up spending tens of millions in an acquisitions frenzy. I didn’t get to see Son of Rambow, an ’80s nostalgia piece about action movie–obsessed kids that earned a cool $8 million distribution deal. But that movie at least sounds like real fun. Predictably, most of the features that scored dealwise were on the safe, earnest, kinda bland side, such as Adrienne Shelly’s posthumously completed Waitress, the Australian dramedy Clubland, and the John Cusack–as–Iraq War widower vehicle Grace Is Gone.

Other big-noise titles expired on arrival, including several exploring (or is that exploiting?) the de rigueur shocking subject of our moment, child abuse. Noses were held around Hounddog (the Dakota Fanning–rape film) and An American Crime (Catherine Keener as a monster foster mom), though child abduction drama Trade won some appreciation. Such controversial flicks were often more exciting in advance hype than onscreen, though conversely several bad-taste movies proved more than edible. Many thumbs went up for vagina dentata black comedy Teeth, and my own at least were hoisted for all-star, Commandments-inspired The Ten (in which Winona Ryder enjoys vigorous pleasuring with a ventriloquist’s dummy), from the good folks of comedy troupe the State. Not to mention (in a different realm entirely) Robinson Devor’s Zoo, an extraordinarily poetic and nonjudgmental documentary-dramatization mix about something you might expect those adjectives couldn’t apply to: the 2005 death of a Seattle man whose colon was perforated by an Arabian stallion’s member.

Zoo was a startling exception to a problem that’s become common among the kind of indie cinema Sundance programs — stuff that, since it’s often funded by HBO or PBS or whatever (or is simply produced with the expectation of a small- rather than big-screen career), tends to look, act, and smell like TV. There’s nothing wrong with that, since good fiction stories can be told and compelling documentaries crafted without the need for great visual panache. Still, the lack of aesthetic excitement, the sheer broadcasty-ness (abetted by so much HD photography) increasingly makes anything that feels like a real film seem refreshing. Examples most often surfaced among more experimental features (yes, they still get programmed at Sundance — you just don’t hear about them), such as Zoo and the ecstatically intimate soccer documentary Zidane: A 21st Century Portrait.

Sundance proved again this year that it’s the premier showcase for movies starring people who can single-handedly make viewing worthwhile. Parker Posey, Sam Rockwell, Vera Farmiga, and Samantha Morton had two entries each. Steve Buscemi, god bless him, had three (including one he cowrote, directed, and starred in). Plus, there were opportunities to see actors like Ryan Reynolds (The Nines), Queen Latifah (Life Support), and Anna Faris (Smiley Face) get the generous roles you knew they were capable of filling. At times at Sundance the US film world almost seems like a repertory company of versatile, brilliant professionals — one that sometimes lets A-list Hollywood guest stars take part, in which context they tend to flounder (i.e., Lindsay Lohan in the achingly dull Jared Leto is Mark David Chapman drama Chapter 27; first-time director Anthony Hopkins’s embarrassing, surreal egofest, Slipstream). They may not get the big breaks, but the cool kids in class can always make the popular ones look insipid. (Dennis Harvey)

Jesse Hawthorne Ficks’s Sundance picks (so far)

Manufactured Landscapes (Jennifer Baichwal, Canada). Easily the best film at Sundance, this moving portrait of Edward Burtynsky’s photographs shakes your views on the progress of humanity to the point of speechlessness. While the photos show how humans have drastically altered the earth through their obstructions — ranging from massive recycling landfills to factory lines with thousands of workers creating millions of tiny plastic objects — Baichwal’s film brings these conflicts to life in a complete, breathtaking manner. The opening shot (filmed by infamous Canadian director Peter Mettler) evokes Jean-Luc Godard’s Weekend and is one of the most powerful sequences I have ever witnessed.

Snow Angels (David Gordon Green, US). In a film that’s purposefully more mainstream than his recent masterpieces, Green (George Washington, All the Real Girls) brings his never-ending compassion to stories about a struggling divorced couple and their young child and two high school teenagers whose awkwardly sincere attempts at first love are just about the closest thing to the real thing. Hopefully, he’ll consider condensing the ending sequence; it screams while the rest of the film simply soothes.

It Is Fine! EVERYTHING IS FINE. (David Brothers and Crispin Glover, US). After viewing Glover’s embarrassingly transparent and ultimately boring debut, What Is It?, I was pretty damn skeptical of the second in his It trilogy. Surprise, surprise — he’s made perhaps one of the most progressive films for physically disabled people to date. Lead actor Steven C. Stewart also scripted the film; the late disabled-rights activist, in a wheelchair most of his life due to cerebral palsy, plays a man whose fantasy is to make love with the long-haired beauties in his nursing home. The film is definitely flawed, and its mixed messages drew uncomfortable laughter from audience members. But though It Is Fine! could be viewed as a Make-a-Wish Foundation film, it genuinely confronts issues untouched by most filmmakers.

Enemies of Happiness (Anja Al-Erhayem and Eva Mulvad, Denmark). With an immediacy similar to that of My Country, My Country, this sensitive documentary about Afghanistan’s first parliamentary elections in 35 years follows 27-year-old candidate Malalai Joya, who speaks out for women’s rights and democracy. It’s a real-life Mr. Smith Goes to Washington to inspire even the most jaded.

And one from Slamdance:

Cold Prey (Roar Uthaug, Norway). How about a group of five Norwegian snowboarders who get stranded up in the mountains, where someone starts hunting them down one by one? OK, so the film doesn’t do anything you haven’t seen before, but it’s fun, terrifying, and part of the new wave of mean-spirited stalker films that thrive on the slaughter of privileged white people. Also, it stars two of the hottest ladies you ever did see. *

Through happenstance I visited Andrew McKinley’s “100 Women/Good Guys to Know” at Adobe Books with one of the show’s subjects. What’s most striking about the photo is probably her expression: open and friendly. This lack of guardedness is one quality of most of McKinley’s female subjects. Enclosed in simple white frames and organized into five rows of 16 and one row of 15, those pieces make up 95 of the show’s more than 100 photos. Loop pedals, those clunky gizmos that allow a single player to assume the scope of a full band, are often enablers of self-indulgence, but Minneapolis’s Dosh (first name Martin) is one of the few who seem capable of layering their own riffs and percussive hits and coming out with something inspired. The cold air these last weeks has played foul-weather friend to a couple chilling stage stories about serial child killers — one of them is even called Frozen. Both were recently toasts of Broadway too, though only one includes scary little apple men (not to mention the titular figure of a giant fellow made of soft cushions). This latter would be The Pillowman, of course, by Irish wunderkind Martin McDonagh (The Beauty Queen of Leenane, The Lieutenant of Inishmore), which makes its local debut at the Berkeley Repertory Theatre in a very strong, utterly engaging production directed by Les Waters.

The theme of child murders aside, the two plays (which opened on consecutive nights) couldn’t be further apart. In fact, that very theme is a source of dispute and humor in McDonagh’s hilarious, eerie, and strictly macabre comedy set in a gritty police station–cum–torture chamber in an unnamed totalitarian country (the fine set, a simple but highly atmospheric take on old-world contemporary, is by Antje Ellermann, with sharply complimentary lighting by Russell H. Champa). Here a prolific but largely unrecognized writer named Katurian Katurian Katurian (Erik Lochtefeld) — a stubbornly emphatic name that’s like an engine that won’t turn over and maybe a bit sinister too, like the clang of a railway car with no windows — has been hauled in for some very rough questioning following a string of child murders whose gory details mimic the content of several of his generally ghastly stories.

Katurian and older brother Michal (Matthew Maher) — whose mental disability keeps him squarely in the role of Katurian’s charge and whom the police keep initially in a separate room down the hall for some questioning at the hands of a bulldog cop named Ariel (Andy Murray) — find themselves in a ghastly little story of their own, threatened with impending execution should the interrogation, led by the somewhat wry Inspector Tupolski (Tony Amendola), not go in their favor. But then, their backstory is, we learn, already quite ghastly, making the writer’s ghoulish tales seem all the more meaningful as a necessary escape from childhood horrors and the inevitable vehicle of the Katurian brothers’ worming segue into adulthood.

The Pillowman, however, ultimately has nothing to do with the kind of social, psychological, moral, and forensic themes brought up by Frozen playwright Bryony Lavery in her secularizing examination of sin and forgiveness. (Frozen runs through Feb. 11 at the Marin Theatre Company; see stage listings for information and the review). Instead, it has everything to do with the art, the incandescent allure, even the vital necessity of simply telling stories for their own sake. As such, its primary purpose is to grip the audience by the story-hungry throat, a feat it manages expertly and with a dreamlike complexity, merging one story into another.

Life and art come hopelessly entangled here, though just which is imitating which is hard to say. After the wily Tupolski (played by Amendola with wonderful humor and nuance like a Stalinist version of Barney Miller) synopsizes one of Katurian’s bleak parablelike tales, for instance, a self-satisfied Katurian savors it by absently applying the term "somethingesque" to its construction. Sure enough, our own Mr. K’s story is strikingly Kafkaesque, and so is the predicament such tales have landed him in.

These ironies and nuances come over without the least bit of pretension, however. They’re just part of the grimly comic nightmare director Waters and his cast unfold with unflinching panache. As Katurian, Lochtefeld (last seen at the Berkeley Rep in another memorable turn as a tortured writer, in The Glass Menagerie) delivers a cannily offbeat, charismatic performance, convincingly mixing bottomless artistic pride with obsequiousness before authority, sibling angst, and a gently subversive humor. Maher’s deft turn as Michal, meanwhile, is an equally riveting combination of utter ingenuousness and playful mischief.

If storytelling seems to be a double-edged sword and maybe even a sword of Damocles, its "spirit" (to borrow from Katurian’s exquisite final line) emerges immaculate in the end as a kind of joyful seduction by the master storyteller, the playwright himself, whose intoxicating yarns remain a boon for all concerned. *

To most, exotica tuneage boils down to Martin Denny and Esquivel; tikis, to that last retro revival that surfed in alongside early ’90s alternative culture. But for this wahine from cosmo Honolulu, exotica meant Quadrophenia mods and Italian scooters zipping around a freezing little island on the other side of the globe — and tikis were simply a fact of life, like those special guest appearances by Pele on street corners. Tiki was all around — it was more radically exotic to sport leather motorcycle jackets under the hot Hawaiian sun.

So Bay Area tiki culture’s latest return — in the form of Alameda’s Forbidden Island and Oakland’s Kona Club — is both surreal and heartwarmingly familiar, a roughed-out, kitschy-koo Hawaiian fusion. I always associated the tiki cult of the ’50s and ’60s with World War II vets nostalgic for humahumunookienookie high times, filtered through mediocre Chinese grub and juicy beverages that even a teetotalin’ mom could easily get toasted on. Here it’s all about vintage peeps, ex-locals, and hearty-drinking pirates in search of novel booty. And the Bay Area is the ideal spot for an ersatz islander experience, what with Oakland being the home of the first Trader Vic’s, Alameda’s Otto von Stroheim continuing to roll out the Tiki News zine, San Francisco’s ReSearch spurring an exotica rediscovery with its Incredibly Strange Music volumes, and the area providing ground zero for the San Francisco Bay Area Tiki Weekend.

The aforementioned gathering is thrown by Forbidden Island co-owner Martin Cate, and the loving care he and fellow big kahunas Michael and Emmanuel Thanos (who also own the Conga Lounge in Oakland) lavished on the nine-month-old lounge is obvious. On this frigid, drizzly Saturday night there’s something vaguely subversive about retreating to a tiki-strewn fantasy island when it’s colder than a sea lion’s tittie outside. Forbidden Island is a fruity-drink lover’s fever dream, boasting fresh-squeezed juices and stealth quantities of silver rum that sneak up and slam you in the puss. Cocktail umbrellas spear dollars to the cork ceiling over an early ’60s back bar, bamboo-sheltered booths, and a dramatically lit Polynesian god overseeing the grizzled locals, water cooler refugees, and fresh- and Fog Cutter–faced collegians, downing spicy grog and Scorpions by the bowl. As I suck down a delish Banana Mamacow of coconut, cream, and rum, my bud Dr. B points out the bodacious, bare-chested native maid in the black velvet masterwork by the bar: "If I had that in my room when I was a teenager, I’d never have left the house." My only disappointment: nary a note of bird whistles, a bongo beat, nor a wisp of exotica in earshot, though the jukebox is said to be crammed with the stuff. Where’s the mai tai moment for the mind’s ear?

Next up on the relative newbie list is the year-old Kona Club on a silent stretch of Piedmont Avenue in Oakland, just a stagger or so away from Trader Vic’s founder Victor Bergeron’s final resting spot at Mountain View Cemetery. Love the tapa cloth–covered walls decorated with ukuleles and old wooden surfboards; the smell of dried lauhala; and the unduutf8g hips of the life-size hula-girl robot. And I’m told the smoke-spewing volcano behind the bar is da bomb. As the Pixies blast over the sound system and Dr. B fetches more Macadamia Nut Chi Chis, I sprawl over a corner table — the sizable crowd appears to be simultaneously more hipster and fratty. Maybe it’s the quiet village of Piedmont that binds us together — the burbies outside are tucked in early while we belly up in our mini-wacky-wiki-Waikiki inside the onetime British brew pub King’s X. Who doesn’t want to recapture some mongrel carefree vacation sensation — in a silly-shack adult Disneyland of thatched straw?

I get rummy and restless, and a clutch of drinkers nearby watches raptly as I manage to make barfly magic and balance a saltshaker on its tip, bolstered only by a teeny mound of grains, for 20 minutes until a barmaid stomps by in a huff and it falls. "Now that’s amazing," the bouncer gathering glasses around me says. The tiki gods are smiling.

GOOD TIMES, OLD TIMEY You can’t toss the tikis out with the tepid bathwater, and you can’t count out bluegrass and old-time music with hoedowns like the San Francisco Bluegrass and Old-Time Festival around. Affiliated with the Northern California Bluegrass Society, the completely volunteer-run, nonprofit eighth annual shindig runs from Feb. 1 to 10; showcases up-and-coming locals such as the Earl Brothers, Circle R Boys, Squirrelly Stringband, the Deciders, Jimbo Trout and the Fishpeople, the Crooked Jades’ Jeff Kazor and Lisa Berman, and the Wronglers (with Hardly Strictly Bluegrass Festival founder Warren Hellman); and closes with a square dance at the Swedish American Hall. This year’s fest also shines a light on a slew of Portland, Ore., combos, summing up a West Coast scene that’s younger than those in other parts, publicity volunteer Elizabeth Smith tells me. "I think that there’s an interest in roots music that’s pervasive in the Bay Area," she explains. "If you go back and look at the hippie scene in San Francisco and the fact that folks in the Dead were involved in bluegrass, you can see an evolution over time." Old times don’t have to mean bad times. *

Behold, a pale port

While sipping my way through a barrel tasting last week, I came across something of a novelty: a California chardonnay port. White port isn’t that unusual, of course; the Portuguese have been making fortified wines from white grapes and from red fermented off-skin for a long time. Still, when most of us think of port, we think of a ruby-colored, almost syrupy elixir, a few sips of which makes a lovely after-dinner drink and, with its sweetness, a good substitute for dessert.

The maker of the chardonnay port is VJB Vineyards, in Kenwood. The winery belongs to that class of ultra-chic, ultra-small-production enterprises that sell most of their wine through their tasting rooms and, in some cases, through subscription lists or Web sites (www.vjbcellars.com). VJB’s chardonnay port, Baci de Famiglia, is produced in rather minute quantities; just 200 cases of the 2005 vintage are available. Given this scarcity, the price — $28 for an elegantly slim 375-milliliter bottle — is surprisingly nonstratospheric.

The port is a pale honey-straw color, like a richer pinot grigio. It is lighter and less syrupy than its red cousins (you are supposed to serve it well-chilled) and perhaps slightly less sweet; most red California ports are distinguishable by their pronounced fruitiness and sweetness. I have never tasted Portuguese white port, but I have tasted ice wines from both Austria and Canada — wines made from very-late-harvest white grapes that are allowed to freeze on the vine before being crushed — and I would say they are the nearest relations of VJB’s chardonnay port, both in color and in restrained sweetness. Certainly, many of the great white dessert wines, even those from France, such as Sauternes, tend to be noticeably sweeter and weightier on the tongue. For a chardonnay wine produced in California, the port is noticeably nonoaky, and the bouquet does carry a hint of apples — a natural and attractive characteristic of chardonnay, though one too often muted or lost altogether in the making of the heavier white wines we cannot seem to wean ourselves from.

The port, I was told, would make a beautiful match with a blue cheese from the Point Reyes Farmstead Cheese Co. (www.pointreyescheese.com), samples of which were just steps away. A novelty pairing? No, a natural one.

On the Download — Ridin’ the wi-fi

ON THE DOWNLOAD Don’t doubt it: southern hospitality is real, and it’s especially so in the rap game now that Lil Wayne and Chamillionaire have released free downloadable mixtapes of their latest rhymes on their Web sites. As mixtapes so often incorporate other rappers’ beats without written permission, the circuit, despite its hype and promotional benefits, has become a sizable source of controversy in the recording industry following the Jan. 16 arrests of DJ Drama and Don Cannon in Atlanta. In a Jan. 21 Reuters-Billboard article, Young Jeezy, a rapper who’s collaborated with Drama and other mixtape DJs, is quoted as saying he was "getting booked for shows in Detroit, D.C., places [he’d] never been" because of his mixtapes, which have each sold thousands. According to the same article, the Recording Industry Association of America is behind these arrests, apparently intending to target "illegal CDs" by way of "anti-piracy activity" — problematic designations at a time when artists and major labels monetarily support their proliferation. Luckily, legalities aren’t trapping Chamillionaire’s and Wayne’s new tapes, which both showcase major steps forward in their talent.

Chamillionaire, hailing from Houston and best known for megahit "Ridin’," posted Mixtape Messiah Pt. 2 on his relaunched site for free download on Christmas Eve. It’s a bitchin’ present, to be sure. This guy’s mixes are anticipated for a reason: his flow’s got such a malleable step that even the simplest rhymes smack of brilliance, plus the man can sing his own choruses. No Akon necessary! (It is, however, a terrific bonus that he appears on "Ridin’ Overseas.") Despite the title, Chamillionaire is disarmingly charming in his sentiments throughout — he comes across as a genuinely nice guy, pledging an end to dis tracks on the skit following his take on Nas’s "Hip Hop Is Dead," a remix that’s considerably more thrilling than what Nas himself committed to record.

As if topping Nas on his own beat wasn’t enough, "Roll Call Reloaded" shows Koopa convincingly imitating several friends, including Lil’ Flip, Slim Thug, and Bun B and Pimp-C of UGK. The gee-whiz factor doesn’t stop there: "I Run It" would be single material if it weren’t all about the biz, and "Get Ya Umbrellas Out" lays down a swaggering, believable promise of continued greatness over an AZ beat: "I’m about to bring the rain so they know how the thunder sound / Get ya umbrellas out."

Umbrellas are also advised as Lil Wayne continues to "make it rain on them" with his own playfully warped flow on Lil Weezyana the Mixtape Vol. 1. Credited to Lil Wayne and Young Money, it’s mixed by Raj Smoove and features MCs from the Young Money label, Wayne’s own imprint alongside Cash Money. The other MCs — including Curren$y and a secret weapon known only as Elle — don’t quite shine like Wayne, who blazes over Jay-Z’s "Show Me What You Got" in a way that leaves one feeling pretty uneasy about Jigga’s supposedly tight rein over the scene. Wayne’s rhymes are always intriguing, including such clever quips as "In the game, I’m manning up like Eli" and "Coupe blue like the do on Marge."

Smoove’s beats constantly switch up their style, allowing Wayne to exhibit his ability to kill just about any beat: "Secretary" employs a scratch-based hip-hop track, while "Vans" is finger snaps and an 808 behind a whispering Weezy. There are more serious moments, as on "Amen" and "I Like Dat," and the sincerity on these tracks is as compelling as the surreal wordplay elsewhere. This tape, alongside last year’s Dedication 2 (Gangsta Grillz) with the aforementioned DJ Drama, shows how dramatically far Wayne’s skill has come since his days in the Hot Boyz — you may not have guessed it from "Go DJ," but this guy is now spittin’ with the best. *

Relationships can suck sometimes. You know, the drama — the toxic chewing at the meat of a romance on the verge of imploding. Your nerves may feel destroyed after going a dozen rounds in an all-night bender over some questionable glance or wry crack, but love’s hang-ups do make for the best songs.

Take it from Des Ark’s Aimée Argote: she has no qualms about expressing herself and is no stranger to confronting her demons through song. A listen to the melancholic lyrics that escape from the Durham, N.C., native’s raspy voice on her band’s recent split EP with Ben Davis and the Jetts, Battle of the Beards (Lovitt), makes that much evident, in the lyrics of drug addiction, sexual freedom, and most prominently, unsparing heartache.

On the acoustic "The Subtleties of Chores and Unlocked Doors," Argote confesses distressingly, "We can get naked together, take dirty naps, whatever / But so long as we suffer apart from one another / You can hold my hand but you can never hold my heart." Throughout the recording the vocalist’s spirit sounds broken as she tells tales of tortured love, a theme that seems to haunt her but never really shatters her self-esteem.

During a recent phone interview, however, Argote’s cheery voice suggested anything but a bout with the blues. "Music is the way I process things that make me sad, and all of those feelings are so hard to articulate," she said. "I feel really inarticulate as a person in conversation form but much more articulate through music. I see it as an opportunity to explain the things that are making me insane, so they usually come out as bummers."

But not all of Argote’s songs sound as if she’s down on her luck. Though her new songs are hushed ballads augmented with acoustic guitar, piano, and symphonic textures courtesy of University of North Carolina orchestra members, Des Ark’s history stretches beyond that. The project began as a trio in 2001 but by the following year shrunk to a two-piece: Argote and drummer Tim Herzog. The pair’s music was a mix of angular riffs roaring from Marshall cabinets and hard-as-nails drum brio. Argote’s vocals ranged from primal wailing to throat-wrenching howling, and together the duo sound reminiscent of PJ Harvey fronting Unwound. Known for in-your-face live shows, Des Ark ditched the stage for floor performances to ensure an engaging experience for band and crowd.

"It’s weird when an audience feels connected to a band but you feel completely disconnected from the audience," Argote said. "I felt it was important to break down the performer and paying customer boundary because it really bothered me and makes music inaccessible."

Videographer Charles Cardello — who released Des Ark’s sole full-length, Loose Lips Sink Ships (2005) on his label, Bifocal Media — sees the connection. "There are not too many performers out there who can simultaneously scare the shit out of you, turn you on, induce fits of hysterics, confuse your musical sensibilities, and rock you to your foundation," he wrote in an e-mail. Argote "could probably just stand there without a guitar and wail for a few minutes, and you’d get the aforementioned effect."

Unfortunately, Herzog’s time in Des Ark was short-lived, and the band’s dynamic soon changed. In September 2005 the duo played their last show together, right before Herzog departed for Washington, DC, to become a bike messenger. Argote disclosed that though the split was amicable, she was really sad when he left.

"When Tim moved away, it was like ‘Well, there goes the one drummer I wanted to play with,’ " she explained. "There’s a lot of phenomenal drummers, but in terms of the type of music I wanted to play, I thought we made a good pair."

After considering a move to DC herself, Argote decided to remain in Durham because "it’s homegrown and not affected by the labels and popularity contests." She also contemplated whether Des Ark’s erstwhile aggressive sound was compensating for qualities lacking in the music. "I think becoming a quiet musician changed the way I perceived space," the vocalist said. "In our culture that’s a way people tend to become oppressed, and I struggle with it a lot. When you walk into a club with a six-foot-something guy and you’re in a loud band, it’s a lot different than walking into a club when you’re a five-foot girl with a banjo."

Argote views Des Ark’s current sound as a natural progression — the EP’s music possesses a certain repose, but the energy remains. Nonetheless, she said that — although she has a small collection of quiet songs she wants to record for her next album — she’d like to throw a rocker or two in.

"It’s not like I sit at home and write rockers, ’cause I also like writing quiet ones as well," she said. "When I’m at home and all I have is my piece-of-shit, busted-up, acoustic thing, I pretty much write busted, piece-of-shit acoustic songs as opposed to loud ones." *

As all English majors know, beginning a sentence with a prepositional phrase can be problematic. Of Montreal — the Athens, Ga., band headed by songwriter Kevin Barnes — proves an exception to this rule, and if it’s a beginning you need, look to Barnes, because it’s starting to look like his finesse in penning clever pop records is boundless. With the new Of Montreal full-length, Hissing Fauna, Are You the Destroyer? (Polyvinyl), Barnes takes nary a stray step on the path to pop bliss, assembling a coherent, front-to-back compelling listen the likes of which someone like Robert Pollard rarely realizes these days.

In a recent e-mail interview, Barnes spelled out the difficult circumstances surrounding its recording: the result is a few shades darker than the ecstatic, candy-colored dance pop on Of Montreal’s last two albums, Satanic Panic in the Attic and The Sunlandic Twins (both Polyvinyl, 2004 and 2005). The emotional depth and refined craft at work render Hissing the group’s most rewarding effort yet.

The disc’s tone isn’t foreign territory for Of Montreal. Barnes points out that "I’ve made records like Hissing before," and anybody would want to dance to the greater part of it, but sitting down to listen illuminates something obvious: the dude who wrote this was unquestionably down. The recording was born of a tumultuous year for Barnes. "I was going through this heavy chemical depression, and I was desperately trying to keep my sanity," he writes. No kidding — one new track, "The Past Is a Grotesque Animal," a 12-minute swirl of anxious uncertainty, sets some serious melancholy right at the CD’s center. Elsewhere, as on the first single, "Heimdalsgate Like a Promethean Curse," cheery arrangements get paired with lyrics of the desperate sort: "Chemicals don’t flatten my mind / Chemicals don’t mess me up this time / Know you bait me way more than you should / And it’s just like you to hurt me when I’m feeling good." According to Barnes, writing this record allowed him "a way of constructively facing" his problems. It’s a good time for him to be on the upswing: riding the popularity of its last two albums, his band is the most successful it’s been since its start in 1997.

As a group once associated with the fabled Elephant 6 collective, Of Montreal dwelled for some time in a sugary subcategory of the American underground: Beach Boys– and Kinks-influenced pop that Barnes speculates may have been "a bit too anachronistic" for most attuned to indie rock. It was 2004’s Satanic Panic that changed things. As to why he thinks this happened, Barnes gives some pretty precise speculation: "I was slowly getting into more dancey and electronic stuff, like Manitoba, Four Tet, RJD2, and Prefuse 73, and I wanted to create something that combined my ’60s and ’70s influences with a slightly more progressive and modern feel." More modern indeed: songs such as "So Begins Our Alabee" and "Disconnect the Dots" have graced many a college student’s stereo. "Labyrinthian Pomp" on Hissing reveals the depth of the stylistic change — the track is informed by the Jamaican dub and ’70s soul Barnes found himself listening to while writing and recording. It seems apt that Barnes, as he mentions in a piece he wrote for Pitchfork, has been listening to departed disco progenitor Arthur Russell. In a sense, the two have similar strengths: like the late Russell, Barnes is capable of producing infectious dance-floor fillers and has shown himself brilliant at pinning down difficult, crippling emotions in a sweet, meticulously arranged pop context.

San Francisco plays host to Of Montreal for three nights this tour because, Barnes writes, when the band plays the city, it "really feels like it’s a communal experience and that we’re not just animals at the zoo." Animals they ain’t. An Of Montreal show is no joke. It’s a giddily passionate spectacle of the sort one rarely encounters — as if the book-reading, scarf-wearing kids suddenly turned into flamboyant musicians throwing a light switch–flickering disco party for the neighborhood, and it’s suddenly everyone’s birthday! Glitter, feather boas, and synchronized bustings of moves abound, and as the costumes change onstage, the band somehow continues to play. Its live brilliance will surely hit new highs this time, aided by the royalty check from last year’s Outback Steakhouse commercial that had an adaptation of the ensemble’s "Wraith Pinned to the Mist (and Other Games)."

What’s in store, exactly? "I don’t want to give anything away," Barnes writes, "but I will say it is going to be an event." If Of Montreal’s past appearances and the new, neighborhood theater–esque video for "Heimdalsgate" are any indication, it’s gonna be a goddamn show, man. *

I thought for sure the next Werner Herzog movie I’d be writing about would be Rescue Dawn, a harrowing POW drama (and a remake of his 1997 documentary, Little Dieter Needs to Fly) due out in late March. But here’s a nugget of très Herzogian weirdness to tide you over: The Wild Blue Yonder, which first screened locally in conjunction with the director’s 2006 San Francisco International Film Festival appearance. Is there any other filmmaker so prolific and creatively diverse working today? Find me one, and I’ll tie on a bandana, retreat to the woods, and name foxes after myself. "Everything that has to do with movies, I love," Herzog imparted on that fateful day at the Castro Theatre amid a discussion that also included a reference to WrestleMania (which he brought up multiple times).

That tacky influence isn’t evident in Yonder, dubbed "a science fiction fantasy" onscreen. The pseudodoc plays like 2001: A Space Odyssey crossed with What the Bleep Do We Know? (not to imply that it sucks as emphatically as the latter, but there are certain similarities). Unlike many experimental works, it has a narrative throughline, with Brad Dourif as an agitated refugee from another galaxy. Seems the "alien founding fathers" traveled to Earth when their home planet — a watery wonderworld with communicative wildlife — started dying. As it turns out, attempts to colonize Earth were less than successful. "We aliens all suck," Dourif’s unnamed pioneer laments, pacing in front of what was to be the alien version of Washington, DC (really some abandoned buildings huddled in a forgotten rural wasteland). "We’re failures!" Meanwhile, human astronauts strike out on their own exploratory mission, ironically earmarking Dourif’s homeland as a possible annex for our civilization.

The notions of a ruined planet and a population desperate to survive play both ways, of course — no matter who the native or the alien is. Herzog’s theme of environmental preservation is further underlined by the remarkable footage he uses to illustrate the abandoned planet, taken beneath ice caps in the Antarctic Ocean. This strange environment could be outer space, and indeed it offers a dreamier take on interstellar travel than the actual NASA footage Herzog uses, of shuttle astronauts in polo shirts and tube socks going about their zero-gravity business.

As Dourif’s voice-over grows more mournful and confrontational, a handful of real-life mathematicians step in for talking-head duty, explaining, among other things, the positive aspects of chaos, the concept of interplanetary superhighways, and theories about colonizing space. One PhD imagines the best way to help humans acclimate to outer limits would be to build a giant shopping mall in space — effectively obliterating anything resembling a fresh start for a population that has nearly ruined itself through overconsumption. Thing is, he’s probably right.

At the SFIFF, Herzog explained that he’s "too Bavarian" to make the Robert Johnson doc that’s been on his mind. But he’s not one to shy away from daring music choices; The Wild Blue Yonder‘s eerie, otherworldly mise-en-scène is heightened tenfold by Ernst Reijsiger’s haunting avant-garde score. If aliens ever do make it to Earth — if they’re not already here, that is — and they’re in the market for a documentarian, they need only see Yonder to know Herzog has the necessary cosmonautical chops. *
