Mayor’s Office releases memo, two weeks later

How can someone this pretty play so dirty?

Two weeks have passed since Mayor Gavin Newsom told me in person that he had every right to waive the attorney-client privilege in giving a confidential memo to the Chronicle.

And today—two weeks and many requests later– the Mayor’s Office finally sent a copy of this memo, which outlines llegal issues in connection with Sup. David Campos’ proposed legislation to extend due process to undocumented youth.

Two days later, Newsom claimed he waived attorney-client privilege, but he kept the rest of the media waiting two weeks before sharing the memo with anyone else.

I guess someone in the Mayor’s Office finally got the other memo from the City Attorney’s Office–the one in which the City Attorney explains how the attorney client privilege cannot be reasserted once it’s been waived.

“You cannot un-ring the bell” is how it was explained to me two weeks ago. And no one in the City Attorney’s Office has told me anything different since.

But in the last two weeks, it has became painfully clear that Mayor Gavin Newsom and members of his staff feel entitled to play favorites in their treatment of the media. That’s unjust and totally sucks, and here’s why:

Up until this moment, the only people who have seen the memo have been the Mayor, members of the Board of Supervisors—and reporters at the Chronicle.

As a result, the only interpretation of what this memo says has been the Chronicle’s. And their interpretation was an extremely negative assessment that included damning quotes from Newsom and seemed to amount to sending a free road map of how to sue San Francisco to any anti-immigrant rightwing nuts who have it in for our city and its progressive policies.

Newsom and the Chronicle are entitled to their opinions. But what Newsom is not entitled to do, once he claims he has waivered the attorney-client privilege, is make sure that no other media outlet has the opportunity to read the memo and then report on what it does and doesn’t say.

But now that I have the memo in hand, I can really see just how dirty Newsom is playing around immigration reform.

As Angela Chan, staff attorney for the Asian Law Caucus, puts it, “The gist of the City Attorney’s memo is that the City could get sued more by anti-immigrant groups. It doesn’t say the City would lose. San Francisco is at the forefront of the civil and human rights movement, which is why it rightly takes on these kinds of issues.”

And as Chan further points out, the City Attorney’s memo does not point out the legal risks that the City is taking by allowing undocumented youth to be deported without due process.

Maybe that’s because the City Attorney’s office, understandably, has little or no experience of immigration law.

But those concerns have been outlined in a 20-page brief by the Asian Law Caucus and four other civil rights’ groups that have tons of experience dealing with these issues.

Sadly, the Chronicle has only dedicated one sentence to what this civil rights brief says, even though it outlines legal issues that are just as important to the City’s fiscal and legal well being.

Reached by phone, Sup. David Campos told me today that the Aug. 18 memo about his legislation identifies the challenges that the City could face under federal law.

“But those are challenges that apply to the whole concept of sanctuary, period,” Campos said. “There’s nothing new here.”

“If anything,” Campos added, “my legislation is arguably more legally defensible, because it’s predicated on state law and its unique treatment of juveniles. So, I don’t think that the way the Chronicle characterizes [the Campos proposal] is accurate. They are making it sound like my legislation makes the sanctuary ordinance politically less defensible.”

As Campos notes, his proposal doesn’t protect undocumented youth , if the court decide to charge them as adults.
“If a youth is charged of something so heinous that court decides to charge them as an adult, then they will be reported to ICE right away,” Campos said. “We decided to have a very modest and conservative approach to address a lot of the public safety concerns that law enforcement would have.”

Campos is also bummed that the Chronicle has never bothered to point out that a lot of legal memos are written, particularly when the city is doing something new and edgy.

As for why Newsom’s decided to release the memo about Campos’ proposal, Campos opined “People are terrified of this issue, and I can see why. I get a lot of hate mail, and this is not a way to promote your political career.”

One last point for now: when I asked SFPD Chief Goerge Gascón’s press officer Sgt. Lyn Tomioka to verify quotes he reportedly made in the Chronicle’s Aug. 19 article, expressing concern that under the Campos legislation, “drug or even violent offenders could be released by judges on reduced charges in lieu of reporting them for possible deportation,” Sgt. Tomoika replied that she has “suggested and Chief Gascón has agreed to read the entire Supervisor Campos legislation, and then give a statement.”

I don’t know about you, but my reaction in reading this reply was to think that it was unfair of Newsom to ask the Chief to comment on a memo about a piece of legislation that Gascón had not yet read.

The week started off in celebratory mood for members of the local immigrant rights community who attended an Aug. 18 rally outside City Hall to support legislation by Sup. David Campos that would extend due process rights to immigrant youth. And it ended, as this issue has a way of triggering, in controversy and division.

"Si se puede," chanted the crowd, hoping that "yes, we can" reform city policies on deporting undocumented young people accused of crimes before their trials. Dozens of immigrant and civil rights leaders representing 70 community groups made powerful speeches, buoyed by the knowledge that seven other supervisors — John Avalos, Chris Daly, Bevan Dufty, Eric Mar, Sophie Maxwell, Ross Mirkarimi, and Board President David Chiu — support the proposal, giving Campos the eight votes needed to override a mayoral veto of his proposed legislation.

Campos, an attorney who came to the United States as an undocumented teenager from Guatemala, told the crowd that he hopes to ensure that undocumented juveniles can only be referred to federal authorities for deportation after a court finds that they have committed a felony.

The Campos proposal, which was introduced during a week-long effort to revive immigration reform efforts at the federal level, seeks to amend a policy shift that the Mayor’s Office rammed through last summer after somebody leaked confidential juvenile criminal records to the San Francisco Chronicle.

Those leaks revealed that city officials had been harboring adolescent crack dealers instead of referring them to Immigration and Customs Enforcement (ICE) for deportation. Within days, Mayor Gavin Newsom — who had just announced his gubernatorial bid — ordered a change in policy.

In the year since that shift took place, city officials have reported an estimated 180 to 190 youths to ICE. But immigrant rights advocates say Newsom has refused to meet with more than 70 local community organizations to hear their concerns about how the change in policy violates due process rights.

"I hope Newsom will look at this proposal and see it for what it is: a balanced and measured process grounded in the values of San Francisco," Campos told his supporters, noting that his proposal does not seek to revert to the city’s original policy, under which no youths were referred to ICE, even when there was misconduct.

Instead, Campos’ proposal seeks to reform the policy that Newsom ordered and the city’s Juvenile Probation Department implemented last July without public debate. As Avalos observed at the Aug. 18 rally, "The policy that was introduced last year only produced a semblance of public safety. It caved in to the politics of intolerance. It was not in line with the city of St. Francis. A veto-proof majority has made sure this legislation passes. Young people deserve better."

But the next day, the mood in the immigrant community soured as they learned that the Mayor’s Office had leaked to the Chronicle a confidential memo from the City Attorney’s Office about the legal vulnerabilities of Campos’ proposed legislation. The paper ran a long, high-profile story on the memo along with critical quotes from Newsom, Police Chief George Gascón, and U.S. Attorney Joseph Russoniello.

As of press time, the Guardian had not been furnished a copy of the leaked memo. But it reportedly warns that passage of Campos’ legislation could jeopardize the city’s defense against the Bologna family, who claim that the city’s policy allegedly allowed Edwin Ramos, now 22, to kill Tony Bologna and his two sons last year. It also reportedly cautions that the Campos proposal could affect city officials who are being probed by a federal grand jury on whether the city’s previous policy violated federal law.

Missing from the Chronicle‘s coverage was any mention that the Ramos case is stalled, with Ramos claiming that he drove the car but did not fire the fatal rounds in the Bolognas triple slaying, and that the shooter has gone underground and is believed to have fled the country.

Nor did the Chronicle note that a committee vetting potential nominees for U.S. Attorney for Northern California has forwarded three names for Sen. Barbara Boxer to consider — Melinda Haag, Matthew Jacobs, and Kathryn Ruemmler. Russoniello, who launched this grand jury investigation and has been openly hostile to San Francisco’s sanctuary city policies, could soon be replaced.

And the Chronicle only dedicated one sentence to another legal memo — a 20-page brief prepared by the American Civil Liberties Union, the Asian Law Center, the Immigrant Legal Resource Center, the Lawyer’s Committee for Civil Rights, Legal Services for Children, and the San Francisco Immigrant Rights Defense Committee. Their memo was prepared to support Campos’ contention that Newsom’s new policy exposes the city to lawsuits, undermines confidence in the police, subverts core progressive values, ignores differences between adults and minors, and violates the city charter.

"In its haste to respond to media stories, the Mayor’s Office and JPD acted precipitously, usurping the role of the Juvenile Probation Commission under the City Charter and failed to abide by the measured approach embodied in the City of Refuge Ordinance," contends the civil rights memo.

The authors of this civil rights memo note that they repeatedly shared their concerns with the Mayor’ Office, JPD, and the City Attorney’s Office about the new policy — which, they observe, "was crafted behind closed doors and hastily adopted in 2008 without a public hearing."

"Yet the Mayor’s Office and JPD have rejected our invitation to work collaboratively with community partners to ensure that the youth are not referred for deportation based on a mere accusation or an unfounded suspicion, and to protect the city from exposure to liability for erroneously referring a youth who is actually documented for deportation," the civil rights memo states.

The civil rights memo recommends that youths not be referred to ICE until five conditions are met: the youth has been charged with a felony; the youth’s felony delinquency petition has been sustained; the youth has undergone immigration legal screening by an immigration attorney; JPD has comprehensive policies to minimize the risk that the youth will be erroneously referred to ICE because of language barriers; and the probation officer makes a recommendation to the court and the court agrees that ICE should be notified.

Reached shortly after the Mayor’s Office leaked the City Attorney’s confidential memo, Campos expressed shock at the manner in which it was released. "It’s an elected official’s obligation to protect the city, and elected officials also have a fiduciary duty," Campos said.

Confident that his legislation is legal, Campos observed that "legal challenges are a reality any time you try to do anything about immigration.

"But it’s interesting that we are talking about fear of being sued, when San Francisco has a long and proud history of facing legal challenges when we believe that we are correct," he added, pointing to the city’s willingness to fight for same-sex marriage, domestic partner benefits, and universal health care.

"The very same people who say that they are afraid of being sued here had no problem defending those issues," Campos said. "Perhaps it is not so popular to defend the right of an undocumented child as those other issues. But that does not negate the fact that we are right on this issue. We should stand up for what is right and we should not be afraid of litigation."

Avalos was equally appalled by this seemingly unethical leak by the Mayor’s Office. "I thought we just had something to celebrate, having a rally to support David Campos’ legislation and now we have memos being leaked," Avalos said. "It’s unfeeling at best. By leaking a confidential memo that contains privileged attorney-client information, you are undermining the city’s legal position on an issue. And obviously you are putting your personal career interests over the city. If the mayor’s political position is more important than the welfare of the city, that’s pretty worrying to the Board of Supervisors."

The City Attorney’s Office responded to the leak by issuing another memo, this time outlining the legal and fiscal perils of leaking attorney-client privileged materials. "Confidential legal advice is not intended to be fodder in political disputes," City Attorney Dennis Herrera stated, noting that he was "not aware of a city official or employee who has acknowledged responsibility for the disclosure."

And, initially, no one in the Mayor’s Office took responsibility for the leak.

"It is my understanding that the Chronicle got it from a confidential source," Newsom Press Secretary Nathan Ballard told the Guardian, claiming that "the Campos bill paints a target on us and puts our entire sanctuary city policy at risk."

But by week’s end, pressure was building on Newsom to reveal whodunit.

"While I welcome the issuance of the City Attorney’s legal guidance reminding the Mayor’s Office and the Board of Supervisors of their obligation to keep attorney-client privileged information confidential, a thorough investigation is needed to hold those responsible accountable," Avalos stated, asking the City Attorney’s Office and the Ethics Commission to get involved.

Shortly after Avalos asked for an investigation, I covered the swearing-in ceremony for Gascón at City Hall, during which Gascón told the assembled that "safety without social justice is not safety."

Struck by the chief’s words, I asked the mayor if he was concerned about the apparent breach of security that occurred in his office when the memo was leaked. Newsom responded angrily, noting that clients, in an attorney-client privilege arrangement, can release memos if they so choose.

"So, you did leak the memo to the Chronicle?" I asked.

"I handed it," Newsom answered, pausing to look at Ballard, "to some of my people." Chronicle reporter Heather Knight was also there and wrote in a story published the next day that Newsom "authorized the leak."

When I asked if leaking the memo was a preemptive strike against the Campos legislation, the mayor went into a rant about how Campos’ proposal could open the city to the threat of lawsuits and the loss of the entire sanctuary ordinance.

But concerns about lawsuits didn’t stop Newsom from pushing for same-sex marriage in 2004. When I asked Newsom to explain this disparity, he dismissed my question and Ballard announced it was time to move along.

FALL ARTS PREVIEW Who would have pictured Green Day’s anthemic 2004 punk-rock concept album, American Idiot (Reprise), as the stuff of musicals? It took merely two unlikely kindred spirits, meeting in the fall of 2007 for the first time: the Oakland band’s lead vocalist, guitarist, and primary songwriter Billie Joe Armstrong and Tony-winning Spring Awakening director Michael Mayer.

Armstrong — that punk-rock diehard who even now plays Gilman with his side project Pinhead Gunpowder? Turns out that as a tyke growing up in Rodeo, he serenaded the elderly and infirm in local hospitals with standards and show tunes from musicals like Oliver! and Annie Get Your Gun.

"That’s how I learned how to sing," says Armstrong, laid back and low-key in stark contrast to the manic rabble-rouser who’ll soon take command over a stage at San Jose’s HP Pavilion. He’s on the phone from his Oakland home during a brief stop in Green Day’s arena tour for 21st Century Breakdown (Reprise), the follow-up to American Idiot. "There’s a real old-school craft to it," he continues, measuring that quality against Shrek, Legally Blond, and other recent disposable Broadway musicals. "That’s kind of a corny way of doing things, but when you see something like Spring Awakening, it’s … it’s real life, and it’s something that everybody relates to, and it’s inspiring and emotional. American Idiot was really tailor-made for something like this to happen to it, y’know."

At the same time that Armstrong tried to heal the ailing with music — and ’80s-era punks everywhere greeted "Morning in America" with a snarl — the generation-older Mayer was earning his MFA on the other side of the country in theater at NYU. No surprise, then, that Mayer "felt such a surprising kind of simpatico" on meeting the Green Day leader. "Even though we come from different worlds and are such different people," Mayer says, "you know, at the end of the day, Billie Joe is such a showman! Such a theatrical guy. Not since Al Jolson have I seen someone so in love with the audience and with putting on a performance for them."

Mayer radiates a similar high-wattage intensity, one that’s fully prepared to kick out the jams. Wide-eyed and unblinking behind his black frame specs, clad in a Justice League T-shirt and floppy shorts, he’s hiding out with me in what looks like an old classroom within the downtown Berkeley building enlisted for rehearsals of the musical version of American Idiot. "I feel like where we connect is old school," he says of Armstrong, slapping the table for emphasis. "Tin Pan Alley." Slap. "Vaudeville." Slap. "That’s the music he grew up with. He became a punk-rocker — I became a theater homo!"

Together, Armstrong and Mayer are making a piece of theater that combines the musical’s narrative tradition and holy union of song and dance with a breed of feisty alternative rock fed by the streetwise political punk of Gilman Street. A musical that unites the ironclad craft of the American Songbook and the heady, arena-sized artistic ambition of classic rock. Now, in the wake of the Broadway acclaim of Los Angeles punk vet Stew’s Passing Strange (which also got its start in at Berkeley Repertory in 2006 and has just been transferred to film by Spike Lee), American Idiot appears poised for critical and popular success when it opens Sept. 4.

American Idiot arrives at a time when musical theater is going through a wave of growing pains. The genre is casting about for ideas, whether they are from films like Shrek and Billy Elliott (to cite a Tony success from last year), or — as with Spring Awakening, which spotlit music by Duncan Sheik — from rock songwriters more comfortable with the life of gritty clubs, merch tables, and tour buses than the mountain-moving, time-devouring, and costly group mechanics of putting on a full-tilt musical. Unlike singularly conceived rock operas like the Who’s Tommy, the first notable union of an established rock band and theater on Broadway, so-called juke box musicals — collections of songs by one group like Mamma Mia! and Jersey Boys — have met with mixed results.

"There’s a whole variety, like Ring of Fire, the Johnny Cash one, that just haven’t made it," opines Michael Kantor, writer of the Emmy-winning 2005 PBS documentary Broadway: The American Musical. "It’s very much dependent on the conception of the director and the book writer who is putting together the story that’s going to encapsulate the music. I do think Broadway right now is keenly scavenging from movies or recordings — anything they feel like they can get quality material from as a launching point."

With the closing of a host of musicals earlier this year, producers are looking for the new and innovative. "Many of the most important musicals," Kantor theorizes, "have come from the most unexpected sources or most unusual approaches." And there’s the scramble for the youth entertainment dollar, as the High School Musical TV-music franchise taps into the passion so many kids have for song, dance, and drama. "Kids are always attracted to musicals," Kantor muses, "but once they get into their midteens, a lot of them lose their interest in musicals as an art form and gravitate to other stuff. High School Musical catches them at their natural inclination for that kind of entertainment. The question is, will a show like [American Idiot] capture that much-sought-after 18- to 30-year-old demographic, which is when musicals tend to lose people. Kids go off to college, it’s not too cool to like musicals, and a lot of adaptations are mainstream or traditional — and it doesn’t appeal to rebellious youth."

Young people also might have a hard time springing for costly theater tickets — yet the kids were out in force, filling the HP Pavilion last week when Green Day played to a hometown crowd with a show punctuated by pyrotechnic pillars of flames and fireworks-style explosions, gleeful costume changes, and squirt-gun shenanigans with Armstrong’s mom. It was a big-room amplification of the string of Bay club dates Green Day played earlier this spring at intimate venues like the Independent, DNA Lounge, and the Uptown.

Below a cleverly conceived 3-D urban skyscape backdrop, Armstrong fully embraced his onstage ham and flexed his crowd-control abilities à la Bugs Bunny in a Looney Tunes cartoon, taking running leaps from the monitors, stage-diving, soloing in the bleachers, donning a faux police cap and mooning each side of the audience, and entreating all assembled to raise their fists or sing along, before launching into more serious numbers like "Murder City," written about the Oakland riots that followed the Oscar Grant killing. Live, the band couples the playfully goofy, childlike comedy that tickles the 14-year-olds up front with the palpable sense of morality — driven by a beaten yet still beating anarchist heart — found on its increasingly serious-minded, idealistic recordings.

Armstrong won’t be onstage for the American Idiot musical — though the production includes a live band — and it’s not the Billie Joe Armstrong or Green Day Story. Instead, the musical is embedded in a specific time and hybridized with video-screen projections that simulate a familiar media-saturated landscape: it’s 2004, in the dark years. America has sent its idiot back to the White House, and we’re on the brink of Hurricane Katrina. Across that stage comes a series of almost archetypal characters one recognizes from the album: the Jesus of Suburbia, here dubbed Johnny for the lead actor it was written for, John Gallagher Jr., who won a Tony for his portrayal of Moritz in Spring Awakening; his antagonist St. Jimmy; and the rebel girl Whatshername.

Just about a week before the concert, the hyperactive, pogo-friendly energy of a Green Day show appeared to be finding its perfect translation at a rehearsal for American Idiot. Three weeks in, the cast — including Passing Strange‘s Rebecca Naomi Jones, here portraying the riot grrrly heroine Whatshername — tackled a round of "She’s a Rebel." In leggings and a Green Day T-shirt, Jones bounced on her toes as a barefoot Mayer dispensed hugs to cast members. A scruffily bearded Gallagher circled the group, then took his place in the desk jockey center for "Nobody Likes You." Choreographer Steven Hoggett tweaked the movements of the cast members as they tossed papers and marched up and down a moveable metal staircase

"When someone is a 20-something with all that angst and energy — where do you put that?," Hoggett said later by phone, pondering the task of "putting songs on their feet onstage." The goal of the choreographer who won an Oliver for his strong, subtle work in Black Watch and came up in the ’90s U.K. clubbing scene: create movement that serves Green Day’s songs and isn’t "too showbiz." To that end, he took in a Green Day show in Albany, N.Y., and fell in love with the mosh pit. "That was absolutely brilliant," he remembers. "Nerves gave way to absolute revelation. It’s just seeing what thousands of people do when they see Green Day — this is the world we need to do onstage."

Collaborating mainly via phone, e-mail, and text with Armstrong from 2007 through 2008, Mayer wanted to focus on a trio of friends — Johnny, Will, and Tunny — as he created the libretto. In true rock operatic form, all the dialogue is sung, using just the songs’ lyrics and text from the special edition CD of American Idiot.

Mayer and arranger Tom Kitt, whose work eventually scored him a spot creating string arrangements for Breakdown, took apart the songs — "letting them breathe in a theatrical way," as Mayer puts it — and placed the lyrics in the mouths of various characters. B-sides and new numbers like "Know Your Enemy," "21 Guns," and "Before the Lobotomy," which Armstrong offered to Mayer during the making of Breakdown last year, were inserted into the flow. Nonetheless, Mayer maintains it was crucial to him to preserve the original track order. "I didn’t want to violate the form of the record," he says. "I wanted to expand it, because the record’s only 52 minutes, and that’s not a full evening, and with these extra characters, they need more material to serve the arcs of their journeys."

It’s been a very personal journey for lead actor Gallagher, who confesses that he’s been a huge Green Day fan since fourth grade, when he’d wait eagerly for the trio’s "Basketcase" video on MTV. His character is Johnny, the Jesus of Suburbia, or as he describes it, "the son of rage and love." Raised in a broken home. Johnny is on "this path, caught between self-improvement and self-destruction, which is something I think we can all relate to," says the actor, who until not long ago had a band of his own. He and Mayer came up with the notion to deepen and intensify Johnny’s descent into drug addiction. "When the chips are down, it’s always easier to just implode on yourself rather than explode outward in a positive fashion that might be helpful for others."

Countering that is the positive process, littered with emphatic yesses, according to Mayer, of putting together American Idiot. In contrast with the difficult but rewarding eight-year gestation of Spring Awakening, Mayer — who has worked on such disparate productions as Thoroughly Modern Millie and the national tour of Angels in America — sees this musical’s trajectory as absolutely charmed. The spell has been in place from the day he proposed his idea to Green Day’s management in 2007, to the moment he was allowed six months to put together a libretto (a process that flew by in six weeks because Mayer says he was so "charged" by meeting Armstrong), to the instant last year that he and coproducer Tom Hulce decided to stage the musical at Berkeley Rep, a company he’d been wanting to work with for years, with his friend, artistic director Tony Taccone.

It’s all coming strangely, beautifully, together — like a punk-rocker besotted with pop hooks and a theater-infatuated one-time Julliard instructor. "It makes me very, very nervous," Mayer confesses, chuckling. "Oh, it’s terrifying! There’s something wrong with it — it’s too joyous. It’s been too easy in terms of everything falling into place."

EDITORIAL At the heart of the conflict over Sup. David Campos’ recent sanctuary legislation is a basic issue of civil rights: Should a young San Francisco immigrant arrested by the local police be treated as innocent until proven guilty — or should that person face deportation, even if the arrest is bogus and no formal charges are ever filed?

All Campos wants to do is establish that an arrest is not a conviction — and, as anyone who works with youth or immigrants in the city knows, thousands of innocent people are picked up by the police every year, sometimes because of simple mistakes, more often because the local cops have a propensity to arrest young people of color in disproportionate numbers.

And under current city policy, anyone arrested on felony charges who lacks proper documentation can be turned over to federal immigration authorities. And even if the suspect turns out to be innocent, he or she can be deported. That’s not fair, not consistent with the city’s sanctuary policy — and, according to the ACLU, not legally defensible.

But Mayor Gavin Newsom, not content with arguing the merits of the legislation (a battle he would clearly lose), has taken the remarkable step of leaking to the San Francisco Chronicle a confidential opinion from City Attorney Dennis Herrera that warned of the potential legal downside of the Campos measure. The Chron quickly turned the memo into a front-page story, proclaiming that the legislation "would violate federal law and could doom [the city’s] entire sanctuary city policy." Newsom was quick to chime in: "The supervisors are putting at risk the entire Sanctuary City Ordinance, which we’ve worked hard to protect," the Chron quoted the mayor as saying.

For starters, that’s blowing the situation way, way out of proportion. Herrera’s office writes these memos all the time. Any piece of legislation that might have legal ramifications gets this sort of review — and in many, many cases, the supervisors and the mayor simply go ahead anyway. Two of Newsom’s biggest initiatives — same-sex marriage and the city’s health care law — involved serious legal issues, and it’s almost certain that Herrera formally warned the supervisors and the mayor that going ahead could lead to lawsuits. Newsom, properly, proceeded with the legally risky moves.

And while we haven’t seen Herrera’s memo, people familiar with it agree that it never said that the existing sanctuary law is at any real risk. Yes, some anti-immigrant group could sue the city over Campos’s bill. And yes, some court could conceivable invalidate not only this law but a lot of other city immigration policies. But nobody has ever successfully sued to overturn the current law, which has been in effect for almost 20 years.

Of course, there are, and will be, legal issues with the Campos bill. But now that the mayor has leaked the confidential memo laying out those concerns, any right-wing nut who does want to sue will have the ammunition prepared. And Newsom’s action makes the prospect of a suit — one that will cost the city a lot of money — far more likely.

In other words, the mayor has put his own city’s treasury at risk, possibly vioutf8g city law in the process, in order to undermine a piece of legislation that he doesn’t support. This has all the hallmarks of the mayor’s new gubernatorial campaign team, led by consultant Garry South, who is known for his vicious, scorched-earth battles. South, we suspect, advised Newsom that appearing soft on illegal immigrants would play poorly in the more conservative parts of the state — and that a tactic that puts his own city at risk was an appropriate way to respond.

And Newsom, to his immense discredit, went along.

This is a big deal, a sign that the mayor is putting his higher ambitions far ahead of his duty to San Francisco. "In my eight years in office, I saw hundreds of these memos," former Board President Aaron Peskin told us. "I saw plenty of material that I could have leaked that would have been useful to me politically. But all of us on the board, across the political spectrum, understood that you just don’t do that. Because if you do, it tears the government apart."

We’re journalists here, and we never support government secrecy. We have consistently defended reporters who publish leaked documents (and would do so here, too, despite our criticism of the way the Chron played this story). And there are times, many times, when it’s best for city attorneys and the officials who get their advice to let the public know what those memos say. We support whistleblowers and principled city employees and officials who defy the rules of secrecy and tell the public what’s really going on.

But Newsom was serving no grand public interest purpose here. He was simply using confidential legal advice to attempt to thwart a political opponent, for the purpose of promoting his own ambitions. That’s alarming. If Newsom wants to be taken seriously as a candidate for governor, he needs to demonstrate that he can stand up to his political advisors — and so far, he’s failing, miserably.

P.S.: Sup. John Avalos has asked the Ethics Commission and the city attorney to investigate the leak, which is fine — but this shouldn’t become an attack on the right of the press to publish confidential documents. None of the investigators should try to question the Chron reporters to seek the source of the leak — particularly since Newsom has as much as admitted, to the Guardian‘s Sarah Phelan, that he was the one who authorized his staff to hand out the memo. *

Restaurants back SF employer health mandate

While the City Attorney’s Office prepares for the final battle in its defense of the Healthy San Francisco universal health care program against the legal attacks by the Golden Gate Restaurant Association, a couple of SF restaurants have filed briefs supporting the city.

Medjool (whose owner, Gus Murad, was the subject of a planning code controversy earlier this year) and Zazie (everyone’s favorite Cole Valley brunch spot) filed friend of the court briefs supporting city arguments that the US Supreme Court should reject the GGRA’s appeal of a Ninth Circuit ruling that the city is legally requiring SF businesses to provide their employees health insurance or pay a fee to support Healthy San Francisco.

“The Health Care Ordinance serves the interests of amici curiae, Zazie and Medjool, medium-sized restaurants in San Francisco, because it enables these restaurants to act responsibly by providing health insurance coverage for employees while maintaining their ability to compete economically. The ordinance further serves the interests of Zazie and Medjool by enabling the restaurants to protect the health of both employees and customers, by ensuring that employees have access to affordable health care services, and by helping to prevent episodes of food contamination by ill employees. Amici believe that not only is the ordinance in their own interest but it is in the interest of all restaurants and San Francisco residents, because it allows businesses to compete in a fair and level context while also ensuring that all San Francisco workers have access to affordable health care,” the brief reads.

BTW, I find it supremely ironic that Mayor Gavin Newsom is using the cost of potential litigation as the main reason for opposing due process for undocumented youth, while Newsom runs for governor citing his two principal achievements – Healthy San Francisco and legalizing same-sex marriages – defense of which have been the most expensive legal fights the city has engaged in since he took office.

After today’s swearing-in ceremony for SFPD Chief George Gascón , (which former chief Heather Fong attended in pants and a pink cardigan,) I asked Mayor Gavin Newsom if he was concerned that someone in his office had leaked a confidential memo about Sup. David Campos’ proposal to extend due process to immigrant youth.

(The City Attorney’s office prepared the attorney-client privileged memo at Newsom’s request. Newsom’s office then leaked the memo to the Chronicle, which cited the memo in an article that was critical of Campos’s legislation.)

The Mayor responded tersely to my question, noting that clients, in an attorney-client privileged arrangement, can release memos, if they so choose.

“So, you did leak the memo to the Chronicle?” I said.

“I handed it,” Newsom said, pausing to look directly at his spokesperson Nathan Ballard,” to some of my people.”

Newsom’s revelation confirmed what everyone already suspected, but it also appeared to be a defensive move.

Yesterday, the City Attorney noted that it was”not aware of a City official or employee who has acknowledged responsibility for the disclosure.,” and stated that this disclosure therefore “may have been unauthorized.

“The integrity of the attorney-client relationship is essential to my ability to do my job effectively, and, by extension, to the ability of all City officials to be fully apprised of legal issues that may accompany their proposals,” City Attorney Dennis Herrera wrote. “Confidential legal advice is not intended to be fodder in political disputes.”

Campos invites Newsom to support due process for all youth

Yesterday’s rally at City Hall in support of Sup. David Campos’ resolution to restore due process to immigrant youth was a who’s who of all the movers and shakers within the local immigrant reform community.

Dozens of community groups, half a dozen supervisors, a representative for Assemblymember Tom Ammiano, Mission High school teacher Derrylyn Tom,, Kate Kendall of the National Center for Lesbian Rights, Patti Lee of the Public Defender’s office, Ana Perez of the Central American Resource Center, Lateefah Simon of the Lawyer’s Committee for Civil Rights, Tim Paulson of the San Francisco Labor Council and Rev. Charles Kullmann of the SF Interfaith Coalition were in attendance, to name a few of the hundreds who showed up.

Noticeably absent were Mayor Gavin Newsom and Sups. Carmen Chu, Sean Elsbernd and Michela Alioto-Pier, none of whom have signed on in support of Campos’ resolution to date. And it seemed like a missed opportunity for Newsom, who needs all the support he can get if he is going to have a chance of winning the governor’s race.

Ana Perez of the Central American Resource Center told the crowd that soon after Newsom’s revised sanctuary policy was implemented last summer, 50 prominent Latino leaders sent Newsom a letter asking him to amend the policy so that immigrant youth would be guaranteed due process.

“California has always been a leader on social issues,” Perez said, as she thanked Campos and the seven other supervisors who are co-sponsoring his resolution to restore due process. ” We have been dismayed by San Francisco’s decision and its current policy which destroys families.”

Chronic debate

For decades, proponents of marijuana reform have argued that cannabis is less dangerous than alcohol or cigarettes, has legitimate medical uses, and should be decriminalized on the grounds that prohibition doesn’t work.

In 1996, these arguments helped convince California voters to approve Proposition 215, which allows the use of marijuana for medical purposes. And in March, U.S. Attorney General Eric Holder signaled a major change in federal drug policy when he said that the Justice Department does not plan to prosecute medical marijuana dispensaries that operate legally under California law.

But the federal government still classifies marijuana as a Schedule 1 controlled substance that has no medical value and a high abuse potential. As a result, cultivation, distribution, and sales of pot primarily occur on the black market, a shadowy mix of small-timers and powerful cartels.

Data from the National Survey on Drug Use and Health (NSDUH) suggests that U.S. growers produced 22 million pounds of marijuana in 2006, worth $35.8 billion, and that California accounted for almost 39 percent of U.S. pot production.

Now, with California’s economy in the crapper, the state budget a mess, and federal judges ordering substantial reductions in California’s prison population, reform advocates are making an intriguing argument: if state or local governments legalize and tax even a fraction of marijuana sales in California, the state could see billions of dollars in new annual revenue and reduced enforcement costs.

Assembly Member Tom Ammiano recalls some laughter in February when he introduced Assembly Bill 390, state legislation to regulate marijuana much like alcohol. "But the budget fiasco has made some people who were dismissive take a harder look," Ammiano said.

A recent California Board of Equalization analysis of Ammiano’s bill estimates that if the state charged $50 per ounce, California would generate $1.4 billion in marijuana taxes annually.

Voters in Oakland also advanced the marijuana policy discussion last month when they approved a special tax on the city’s medical cannabis dispensaries. And in August, a three-judge federal court ruled that California must develop a plan to reduce its prison population by 44,000 over two years.

The public also seems to support making a change. In April, a Field Poll confirmed that for the first time a majority (56 percent) of California voters support legalizing pot.

Depite these advances, Ammiano says he wants to be strategic with his bill, gradually building support. "That’s why we made it a two-year bill," Ammiano said. His bill is scheduled for its first hearing at the Public Safety Committee, which Ammiano now chairs, by year’s end.

But some Bay Area activists aren’t waiting on Ammiano. Last month, Richard Lee, who operates four medical marijuana dispensaries in Oakland, filed initiative paperwork with the state and hopes to gather enough signatures to qualify a Tax Cannabis initiative in 2010.

Ammiano’s bill and Lee’s initiative allow recreational use of marijuana, penalize driving under the influence, and charge a $50 fee per ounce. But they differ around regulation and how to deal with the overarching problem of federal law. Ammiano’s legislation assumes a statewide system that mirrors the federal Department of Alcohol Beverage Control. Lee’s initiative leaves regulation to each county, similar to the patchwork approach to alcohol in other states.

Lee believes his initiative gives people more options. "We can’t order people to break federal law — that would be thrown out," Lee said. "Forty jurisdictions already permit medical marijuana cooperatives in California. So we already have that system, and we’ll follow that reality."

Sup. Ross Mirkarimi, who authored San Francisco’s medical cannabis dispensary regulations, believes it’s important to lay the groundwork at the local level. He points to the relative lack of growth in new municipalities that allow medical dispensaries since voters approved Prop. 215, calling it evidence of pot-related NIMBYism.

"Everyone says they support it, but they don’t want it in their own backyards," said Mirkarimi, who wants San Francisco to become the first U.S. city to add marijuana to the list of medicines it dispenses. "But the city Attorney’s Office is shy about pushing this envelope."

Mirkarimi wants to follow Oakland’s example and add a gross receipts tax to medical marijuana dispensaries in San Francisco.

But the legalization push has its fervent critics. At a recent Commonwealth Club debate on the economics of marijuana, El Cerrito Police Chief Scott Kirkland, who led the charge to ban medical dispensaries in his city, tried to discredit arguments that legalization will save money.

"I’m very disappointed with the state," Kirkland said, claiming that the BOE’s analysis drew almost exclusively on the work of Jon Gettman, a former director of National Organization for the Reform of Marijuana Laws.

"We have to have statistics we can rely on," said Kirkland, who then cited the same BOE report — it estimates that pot prices will drop 50 percent and consumption will increase 40 percent — to support his contention that legalization will lead to increased substance abuse.

Kirkland also challenged the notion that Mexican drug cartels will leave once the pot business is legitimized and regulated. "They understand that the money involved is astronomical," he said. "It’s wishful thinking that if you legalize marijuana, all of a sudden the cartels go away."

He also disputed claims that legalization would help empty state prisons. "It’s very common for advocates to associate legalization with reducing the costs of incarceration, but it’s a fallacy," Kirkland said. "It’s very rarely that a person goes to prison for their original offense."

Kirkland topped off his attack by citing the state’s June 19 decision to add marijuana smoke to its Proposition 65 list of substances known to contain carcinogens.

But BOE spokesperson Anita Gore refuted claims that their analysis relied entirely on reform advocates’ research. "Being as this is an underground activity, the resources are limited," Gore said. "But our researchers and economists used econometric models that are generally accepted and looked at all the available resources, which included academic and law enforcement studies."

Gettmann told the Guardian he uses data from NSDUH, the U.S. Drug Enforcement Agency, the Office of National Drug Control, and the Bureau of International Narcotics — sources the prohibitionists also draw on. He admits that it’s hard to quantify a black market.

"But it’s easy for anyone to understand basic regulatory economic theory," Getmann said. "Marijuana use produces costs for society, but is largely untaxed. So users and sellers reap benefits, while taxpayers bear the costs."

He believes many advantages of legalization are qualitative. "It’s a better regulatory system for financial and fiscal reasons and for restricting access on the part of teenagers," Gettman said.

Stephen Gutwillig, state director of the Drug Policy Alliance, points to research by the Center for Juvenile and Criminal Justice in San Francisco, which found that arrest rates for everything in California have declined since 1990 — with the exception of low-level marijuana crimes. CJCJ’s research shows that rates for this group increased 127 percent since 1990, and 25 percent in the last two years.

"It’s a system run amok," Gutwillig said. He notes that of the 74,000 people arrested for marijuana-related offenses, 20,000 are youth. "The marijuana problem is increasingly becoming a mechanism for social control of young black and brown men in California."

"We feel that money is definitely a fine consideration," he continued. "But even if reguutf8g marijuana didn’t produce a dime, these punitive, wasteful laws must end."

Gutwillig’s group has estimated that legalization would save California’s state and local governments $259.7 million annually in court and incarceration costs alone, a figure DPA researcher Betty Lo Dolce said is very conservative.

"I don’t know if folks have a secondary offenses, so I don’t know if marijuana was legalized, if they wouldn’t be in state prison," Lo Dolce said. "Or conversely, if they may not have been arrested for drug-related crimes, but then those charges got dropped and they ended up inside because of secondary drug-related offense."

Bruce Mirken, communications director for the Marijuana Policy Project, believes that advocates of California’s Campaign Against Marijuana Planting (CAMP) should have to justify that the program does some good.

"The idea that enforcing prohibition and seizing 5.5 million plants last year would be less costly than legalizing is crazy," he said.

But what about the public health costs?

UCLA pulmonologist Dr. Donald Tashkin said that the state added marijuana smoke to its Prop. 65 list, based on finding carcinogens in that smoke. "But you cannot translate chemistry into chemical risk because you have to take into account potential opposing effects," Tashkin said.

His research has found no association between heavy marijuana use and increased risk of lung cancer and pulmonary disease. Conversely, he and Dr. Donald Abrams, a cancer researcher at UCSF, have found that THC, marijuana’s main psychoactive ingredient, has an anti-tumor effect.

"The bottom line is that you cannot use pulmonary risk as a justification for not legalizing it," Tashkin said.

Dr. Igor Grant, director of medical cannabis research at UC San Diego, said the question around marijuana smoke is quantity. "It’s not like cigarettes," he said. "Most people don’t smoke 20 joints a day for 20 years. But even if it was declared safe for patients, you wouldn’t want parents filling the room with smoke."

James Gray, an Orange County judge and a member of Law Enforcement Against Prohibition, believes marijuana is here to stay. "Instead of moralizing and punishing people for failing on moral chastity grounds, let’s manage its use," Gray said. "If people are using it, they should be able to know what’s in it."

The most harmful thing about marijuana, Gray contends, is jail. "The remedy is far more dangerous than the disease itself," he said. "There are thousands of people in prison because they did nothing but smoke pot, and a dirty drug test was a violation of their parole…. But I understand that some people in law enforcement stand to lose a great deal, and that the Mexican cartels are going to invest a lot of money in Madison Avenue advertising."

Lee, too, acknowledges the opposition, but remains hopeful. "People are coming out of the closet," he said. "That’s what caused the gay rights movement to take off. It’s starting to happen around marijuana use."

The Moss Room

The basement restaurant is an odd duck — odder still if the basement is in a museum in a relatively remote park. Yes, my 16-ton hints do pertain to the Moss Room, the venture orchestrated by Loretta Keller and Charles Phan that opened last fall in a subterranean sector of the new Academy of Sciences building in Golden Gate Park.

A word, if I may, about that building, which faces its nemesis, the DeYoung Museum, across the concourse the way Minas Tirith faced Minas Morgul in The Lord of the Rings: one fair, the other sordid. The Academy of Sciences building is, for me, the far superior design because it subtly but unmistakably refers to its predecessor and because, with its expanses of glass and filaments of steel, it sits in its sylvan setting far more lightly. It does not imperially impose itself on its surroundings. Also, it has the Moss Room.

Strange to say, but the restaurants the Moss Room most resembles are both downtown, where the Academy should have been moved. One is Shanghai 1930, a similarly elegant basement, like a lavish bunker. The other is Bix, above ground but with underwaterish light and a bold staircase. At Bix, the staircase rises to a mezzanine; at the Moss Room, it descends from a cafeteria to the subterranean sanctum and adjoins a channel-like aquarium and a wall garden.

These design details suggest the restaurant’s commitment to sustainability, and as weary as sometimes one grows in using that word, it’s probably worth repeating with respect to a place that is inside a science museum in the middle of a large urban park. If any restaurant should be attentive to food’s ecological dimension, it should be the Moss Room. And it is, with the passion extending all the way to the wine list, which is organized under the rubrics "organic," "biodynamic," and "sustainable."

The Moss Room’s look doesn’t suggest its kinship to Keller’s other restaurants, Bizou and Coco500. The former was like the best restaurant in a quaint Provençal town, while the latter offers a slightly deracinated spareness meant to appeal to urban youth. The food, though, is another matter. Keller has long been a leading exponent of a cooking style I associate closely with Zuni Café: the cuisine of Italy and the south of France, fluffed and freshened. We could call this style "rustic" or "lusty," to use two clichés much favored in a certain cliché-choked competing venue — but let’s not. How about "lustic"? Or perhaps "lustique"?

Because the Moss Room, despite being below the water line, is a more elegant venue than either Bizou or Coco500 — a carpeted hush, dim lighting, high ceilings, the zen spectacle of drifting aquarium fish and herbs growing from the wall above them — there is a certain tension about the food. Should it be elegant or lustic? Can it be both? When you try to be both, you risk being neither.

The small plates reflect a certain restlessness. They range from a humble plate of hummus and pita bread ($10) — glistening like naan — embellished with roasted red-pepper and manouri cheese, to the more elaborate batter-fried squash blossoms ($9) zipped up with goat cheese, mint, and roasted-garlic aioli.

A bowl of corn chowder ($8) did strike me as quite Kelleresque. The corn came from Brentwood, and the chowder was made with chicken and shrimp stocks, along with bits of bacon for deeper flavor. Summer corn is famously sweet, of course, and shrimp stock can intensify this effect. So can under-salting. Luckily, fate provided us a small bowl of sea salt.

Equally Kelleresque was a bowl of squid-ink spaghetti ($12) tossed with a meaty mix of squid and sun-dried tomatoes sharpened with chili flakes and what the menu called "herbs." This dish was visually striking, with the zinfandel-colored strings of pasta looking like a clump of kelp, and its flavors glowed with a steady dark heat.

I caught a milder wave of the same effect with the local albacore ($26), a pair of seared chunks looking like roulades embedded on a textured carpet of roasted eggplant shreds and tomato quarters, with a pale green purée of summer squash piped around the perimeter. Albacore is wildly underrated and is worth searching out.

As for salmon: I like it but don’t love it, and when our server explained that the wild Alaskan version ($23) consisted not of a filet but of flaked flesh tossed with English-pea cavatelli and a north African blend of radish, mint, and preserved lemon, I silently cheered. Salmon can be overbearing and rich, but here the kitchen induced it to cooperate with its platemates.

Speaking of platemates: Greg’s cookie plate ($9) offers a petit-fours-like array of tiny treats. It’s ideal for sharing, and you get lots of bites with not much heft. For the heft-minded: a roasted-peach tart ($9), accompanied by a lump of crème fraîche custard and grainy peach sorbet. Close your eyes and think of the Stairmaster.

ANGELA CHAN

As staff attorney at the Asian Law Caucus, Angela Chan has been at the forefront of a yearlong effort to ensure that all undocumented juveniles have the right to due process in San Francisco.

That effort began last summer, shortly after Mayor Gavin Newsom, who had just decided to run for governor, announced that undocumented juveniles henceforth would be reported to federal authorities the minute they are booked on suspicion of having committed a felony — and before they can access an immigrant-rights lawyer.

These changes primarily affect Latino youth, but Chan, whose Cantonese-speaking parents ran a restaurant in Portland, Ore., sees the broader connections to other immigrant communities.

"I grew up in an immigrant community in a white working-class neighborhood," Chan explained. "I saw the barriers — language, culture, racism, xenophobia — and I realized that there was not a lot of power and awareness. I learned to appreciate civil rights."

As a teenager, Chan was determined to become an attorney. The temporary passage of California Prop. 187 — prohibiting undocumented immigrants from using social services, health care, and public education — intensified her determination. Chan graduated cum laude from Harvard Law School, and has been able to focus on this particular juvenile justice battle thanks to a Soros Justice Fellowship and the ALC’s "innovative, fluid, creative, and client-centered vision."

"I’ve tried different ways of challenging inequality — direct confrontation, anger — but I’ve found the best way is through policy, and being very educated and strategic," Chan said.

She said she’s hopeful that Sup. David Campos has the votes this summer to pass veto-proof amendments to the city’s undocumented-youth protection policy. As she put it: "People are starting to understand the difference between the juvenile and adult justice system and the issues around due process." (Sarah Phelan)

Take a look at just a few of the things Julian Davis has done: He ran the 2008 public-power campaign. He’s on the board of San Francisco Tomorrow. He’s president of the Booker T. Washington Community Service Center. He’s a founder of the MoMagic Collaborative, which fights youth violence in the Western Addition. He’s on the board of the San Francisco Housing Development Corporation. He’s been appointed by the Board of Supervisors to serve on the Market-Octavia Citizens Advisory Committee. He’s a founder of the Osiris Coalition, which is working to ensure that public-housing tenants have the right to return to their homes after renovations. He’s hosted countless events for charities and political campaigns.

Then think about this: he’s only 30.

Davis grew up in Palo Alto, and moved to the corner of Haight and Fillmore after getting bachelor’s and master’s degrees in philosophy from Brown University. Philosophers weren’t exactly in demand at the time, so he wound up "playing my guitar on the streets for burrito money" while starting a PhD program at Stanford.

He also saw three people shot to death on his corner. "And I realized," he explained, "that the academic life wasn’t going to be for me."

Davis started organizing against community violence, and, inspired by Matt Gonzalez’s mayoral campaign, ran for supervisor in 2004. That got him started in local politics. He’s headed to law school at Hastings this fall, and it’s a safe bet that he’ll be a leader in the progressive political community for years to come. (Tim Redmond)

DAVID SCHOOLEY

"He’s a visionary. He’s very determined. He never gives up."

That’s how Ken McIntire, executive director of San Bruno Mountain Watch, describes David Schooley, who founded the Mountain Watch nonprofit four decades ago.

"For many years, David led every Sierra Club hike, organized every restoration party, and even took the bus to community fairs up and down the Peninsula so he could set up a table and distribute fliers about San Bruno Mountain," McIntire recalls.

Now snowy-haired and allegedly semiretired, Schooley, 65, remains as nimble as a goat when it comes to hiking across his beloved mountain, which rises and cuts across the Peninsula just south of San Francisco in San Mateo County — and whose ecosystem has been identified as one of 18 global biodiversity hotspots in need of protection

Schooley’s love for the mountain — which is covered with low-growing grasses, coastal sage, and scrub year-round and is dotted with wildflowers each spring — led him to found SBMW in 1969 and fight the expansion of the Guadalupe Valley Quarry and the growth of nearby Brisbane. Both were threatening to destroy the biggest urban open space in the United States and the habitat of rare butterflies, including the San Bruno elfin.

As Schooley explains, while the mountain is often hit with strong gusty winds and enveloped in thick fog, it is a great butterfly habitat and the last fragment of an entire ecosystem — the Franciscan region — the rest of which has been buried beneath San Francisco’s concrete footprints.

Two years ago, Schooley had the pleasure of once again finding the tiny raspberry-colored elfin caterpillars on some sedum (its host plant) on the north-facing upper benches of the quarry.

"It’s a miracle," Schooley told me at the time, delighted by this living example of nature’s ability to overcome human-made damage on the mountain.

At the time, Schooley was hoping the state park system would annex the property where the elfins were found. That hasn’t happened yet. But as McIntire says of Schooley (who dreams of a wildlife corridor that runs from the bay to the ocean), "David is always pushing for more open space around the mountain, for more nature and less development, and trying to reach a bigger audience." The San Francisco Mime Troupe is the conscience of the city, our proudest export, and — as it celebrates its 50th year — perhaps our most enduring sociopolitical institution. That’s a lot of kudos to heap on an artists’ collective, particularly one that delivers its theatrical social satire with such over-the-top comedy and music, but it isn’t a statement that we make lightly.

The SFMT embodies the very best San Francisco values — limitless creativity, a hunger for justice, courage under fire, an uncompromising commitment to creating a better world, and a progressive missionary zeal — and offers a powerful and entertaining reminder of those values every July 4, when it presents its new show in Dolores Park.

After it sings (and preaches) to the progressive choir of San Francisco, the troupe hits the road, visiting such less-than-enlightened outposts as the Central Valley and rural Northern California, delivering important messages to audiences that need to hear them most. "First of all, it’s humorous, so that breaks down a lot of barriers from the get-go," SFMT general manager Jenee Gill tells us.

But even here in the early ’60s, the San Francisco Recreation and Park Commission tried to use obscenity laws to ban the SFMT from performing in public parks. The troupe successfully fought the commission in court, setting an important free speech precedent. Modern San Francisco has grown up with the SFMT showing us the way forward with its uniquely high-stepping, knee-slapping, consciousness-raising style, and we’re a better city for it. (Steven T. Avalos on the budget process

Editors note: Sup. John Avalos sent this letter in response to criticism (including criticism from the Guardian) of the city budget process.

Responding to Tim Redmond’s editor’s notes posted on July 22: Robocop is one of my favorite movies too, especially for its anti-privatization message. Over the last 5 years that I worked in City Hall, I have actively opposed efforts to privatize City services like the security at the Asian Art museum and custodial work at City Hall. This year, when Jail Health Services were threatened to be contracted out to a for-profit corporation, I led the effort to push back, visiting both jails and meeting directly with those most impacted by the move.

As of June 29th, the night of the last Budget and Finance Committee hearing on the mayor’s budget, the Budget Committee had freed up only $20 million in cuts to prevent the massive cuts imposed by the Mayor. This was nowhere near enough to stop all the Prop J’s, the Mayor’s effort to contract out services, and restore cuts to essential services. Stopping the Prop J’s alone cost over $20 million.

Late that night, I met with a broad array of budget constituent representatives: seniors, youth, SRO tenants, city workers, homeless advocates, to get their input on priorities and strategies before President Chiu and I went headlong into negotiations with the Mayor’s office.

By the night of July 1st, we had $43 million to stop ALL the Prop J’s and restore over 23 million in other priorities.
We kept shelters open 24 hours, restored substance abuse and mental health services such as the single standard of care for mental health, continued immigrant rights and tenant services, protected seniors from losing meal programs and having to pay social workers to help them with their finances, prevented cuts to family support and violence prevention services, restored rec director jobs, rejected charging families for their child’s detention at YGC, reoriented the Mayor’s administration towards community development, promoted transit first parking policies, and set aside millions of dollars for job programs at the airport, port and PUC.

But I would not credit two newbie supervisors’ negotiating skills for restoring an unprecented $43 million in restorations in the worst year possible.

Writers’ Block: Precita Eyes’ Urban Youth Arts Festival

Precita Eyes — the community-based non-profit responsible for beautifying Mission street walls and educating San Francisco on mural art for over 30 years — has quite a celebration planned for their upcoming 13th annual Urban Youth Arts Festival. Live music performances, from local headliners to up and coming performers under the age of 20, will rock the park. Young heads will craft colorful aerosol art on open canvases, or you can throw down some paint yourself if you can an available board. I got a chance to catch up with the head organizer of the event, Precita Eyes’ youth arts coordinator Eli Lippert, just before he got too busy preparing last minute touches for Saturday’s festivities.

SFBG How did you get into Precita Eyes?
Eli Lippert I started coming to Precita Eyes as a student in the youth arts program that I’m now running. I started when I was about 14 going to classes here and then stuck with it. I got involved with painting murals and doing more projects. I got a little older, and now I’m actually teaching the class and running the program that I was a part of. You could say I’m kinda’ a product of my environment.

SFBG What is the makeup of the youth arts program?
EL It’s still pretty much the same setup. There’s two weekly ongoing classes that are year-round. One is called the urban youth arts program and the other is the youth mural workshop. They’re for teenagers mostly ages 11 to 19. A lot of the kids that come through are interested in graffiti and more urban styles of art. So in the urban youth arts class we center on that kind of stuff and then in the youth mural workshop we focus more on the various processes of painting.

SFBG Do a lot of the students have an interest in doing illegal graffiti art?
EL Well, some of them do. Some of them have done it in the past or in their own time before coming to Precita Eyes. It’s not something that we promote for the kids to do. But most of them have come from a graffiti background, even myself, I started out doing graffiti — as entree into the art world, I guess I would say. But what we try to do is to get them to channel the energy that they have for [graffiti] and put it into something positive for the community. So the students can show the community what they can do with all this energy and talent that they have.

SFBG Does Precita Eyes teach students how to get legal art out there in public space?
ELThat’s also part of my job — to find things like that and organize the group. But the students are always involved in some part of it. For example in the magazine class we got a grant, but the grant is a student-based grant. It was written entirely by our students. So they were involved in the whole process, and they got more of an idea of the different artistic avenues from the ground up.

Chef Charlie Kleinman is purported to smoke some sweet applewood-smoked Baby Back Ribs, which you’ll each get ½ rack of (add $8 for a full rack) as your main course, accompanied by house BBQ sauce, BBQ-baked Cranberry Beans, Corn Bread with spicy honey butter and Creamy Cole Slaw. Though the menu changes, this Saturday offered first courses of either Smoked Nante Carrot Soup with lime zest and Fresno Chili (which they use a lot of here) Sour Cream, or a Little Gems Salad with house-made ranch, smoked cippolini and cornbread croutons (picking up on the smoked theme?) Dessert is your choice of berry short cake with creme fraiche biscuit, whipped cream and berries, or Hamada Farm’s heirloom watermelon topped with fleur de sel and house chili powder. Wine pairings are an additional $15 and different wineries and winemakers will be featured. Is your mouth watering yet?

PREVIEW Arriving outside Amoeba Music on Haight Street, Fillmore Rich — also known as the MTV2 rap star Big Rich — is stopped by a total stranger. "Yo! Big Rich. Man, I love "SF Anthem," and "That’s The Business," and all your music," the fan/rapper enthuses, quickly turning the chance sidewalk meeting into an impromptu audition. As the aspiring rapper — who shouldn’t be making any immediate plans to quit his day job — rattles into his second verse, large-framed Rich listens intently. Afterward he offers words of encouragement, and even his phone number, to the upstart.

Big Rich’s Heart of the City (3 Story Muzik) is one of Ameoba’s top-selling hip-hop albums. "I feel like it’s a part of my responsibility to give back to my community," Rich says. "That’s why I call myself Fillmore Rich. It’s not to glamorize anything. It’s just that’s how I feel. All the people I grew up with, they ain’t here no more. I feel like it’s my responsibility to stay here and represent and help where I can. I am the only San Francisco rapper that still has a residence in the neighborhood where they grew up."

This Saturday, Rich will be there when the SF youth AIDS education organization Get Live Stay Live puts on an event at the Bayview Opera House. "There’s [been] a lot of friction going on with my area and Hunters Point," he says. "I’m going to show there ain’t no friction." Rich has two other events booked the same day: he’ll be speaking on a panel at the Bay Area Producers Conference and performing at the car-themed Hot Import Nights mega-event at the Pleasanton Fairgrounds. SF International Poetry Festival

PREVIEW San Francisco is known internationally for many things, but top among them are parties, politics, and poetry. We’ve got plenty of events dedicated to the first two, but it’s surprising that we didn’t have a full-blown poetry festival until two years ago. Thankfully, the city, the public libraries, and the Friends of the library are back this year with four days of events dedicated to the medium that made Allen Ginsberg, Robert Duncan, and Lawrence Ferlinghetti famous — with an intention of continuing the tradition as a biennial gathering. This round features main stage readings by local heroes and international stars like Maram al-Massri, Daisy Zamora, SF Poet Laureate Diane di Prima, and Ferlinghetti himself. Other highlights include an exhibition of artwork and broadsides from participating poets, screening of a documentary about Jack Hirschman, a conversation about the art of translation, an event for youth moderated by California state Poet Laureate Carol-Muske-Dukes, workshops, parties, and a North Beach Poetry crawl that includes stopping in at Ferlinghetti’s City Lights bookstore and other famous haunts of the Beats. Best of all? Like creating poetry itself, all events are free and open to the public.

PREVIEW A torrent of questions arose amid the global mourning over Michael Jackson’s sudden passing. Was he addicted to prescription pain meds? How much was he actually worth? Did his father’s abuse scar the star beyond repair? Speaking of paternal influence, will 12-year-old Prince Michael Jackson follow his famous father’s musical calling? If he displays even an ounce of MJ’s talent, the pressure will be enormous.

A similar scenario played out in the African music world following the 2006 passing of Malian blues guitarist Ali Farka Touré from bone cancer. Farka Touré’s son Vieux expressed an early interest in music, but his father objected, hoping to shelter him from a professional musician’s grueling tour circuit. It didn’t work. Vieux picked up the guitar, releasing a self-titled debut on Modiba/World Village in late 2006, followed by the creative, youth-embracing Remixed: UFOs Over Bamako (Modiba) in 2007. With guidance from legendary Malian kora player Toumani Diabat, the younger Touré’s first two releases express a reverence for his father’s emotive, blues-soaked guitar style while exploring rock and electronic music interests.

These traditional and modern threads entwine so thoroughly that they fuse on the new Fondo (Six Degrees). Vieux gives voice to swirling Saharan dust storms on the energetic "Sarama," explores Mali’s quiet spirituality on "Paradise" (featuring Diabate’s kora solos) and ponders West African struggles in the 21st century on the reggae-tinged "Diaraby Magni." Like his father, Vieux’s music has taken him from Bamako, Mali to Bonnaroo, the massive Tennessee music festival where his American summer tour begins. As U.S. indie bands like Vampire Weekend and Fools Gold incorporate African rhythms into their repertoires, it’s worth hearing a talented African guitar hero whose taste for rock isn’t just skin deep, it’s in his DNA.

SUPEREGO Obama’s been in office for a whole 200,000 blog centuries, but times are still so tight I have to make my own mascara out of Marlboro butts and melted-down pantyhose. Why won’t he magically fix everything immediately! Flasks are making a flashy comeback on the club scene, spontaneous street parties are all the rage, and 2 p.m. at Dolores Park is the latest rave time for the hip, half-naked underemployed. (The free San Francisco Symphony performance then and there on Sun/19 will be an awesome culture clash.) It’s a freakonomical conundrum that just as delicious-sounding specialty cocktails are taking off and a new crop of fascinating DJs are touring, no one really has the ducats to taste or hear them.

But the worst thing you can do is stay home. Fortunately, some of the best parties in the city are free — and many more, don’t forget, are gratis if you arrive early enough (bring a crossword or something) or pimp inventive drink specials to help you fight the squeeze. SAT IN YOUR LAP: THE LATEST DAUGHTERS OF KATE BUSH FLESH OUT THIS WOMAN’S WORK

Kate Bush was gifted with a fierce female originality at a time when the rock world was starved of it: her golden run of eccentric achievement in the late 1970s and early 1980s placed her next to Joni Mitchell in terms of adventurous — if not always intellectual — influence in the minds of aspiring young women singer-songwriters. (And there’s some extremely perverse pleasure to be taken in the little factoid that her stunning 1985 EMI comeback album Hounds of Love snatched the top U.K. album slot from Madonna’s Like A Virgin.)

But that gift was also a curse: Bush was so original in so many ways that it’s easy to forget the myriad musical pathways she forged. This “artist in a female body” — as she famously protested when her panicked record company started pimping her rack on sleeves to shift units — has mostly been boiled down to spiritual oracle, swooping-voiced Sybil, and, ever since concept albums by women were banished to exile in Guyville, keeper of the idiosyncratic prog-rock flame. In other words, Stevie Nicks with a Fairlight synthesizer and a degree in Celtic mythology. Or else just plain weird.

Fortunately, musical weirdness is so much with us today that other Bush qualities are starting to be glimpsed through the babushka, including her production abilities, precocity, sincerity, humor, and unabashed gender-fucking. For the past three decades, it’s never been rare for artists to be compared to Bush — mostly for childlike vocalizations or way with a silver space suit and Circe metaphor. But in our post-neo-neo-soul moment (sorry Wino), a new crop of female British singers has arisen that takes its cues, mostly acknowledged, from Bush’s kaleidoscopic talent.

FLORENCE AND THE MACHINE

Without Kate Bush, flouncy freak-folker Florence Welch and her ever-changing backup band could be heard as a product of the unholy union of Devendra Banhart and Tori Amos — except those two probably wouldn’t exist without Bush either. Florence grounds her lyrics in the sexually frantic Bush. “I must be the lion-hearted girl,” she sings in the vid for “Rabbit Heart (Raise It Up)” just before her wedding banquet table folds up into her coffin.

MARINA AND THE DIAMONDS

Marina and the Diamonds, a.k.a. the singular singer Marina Diamandis has been gaining huge traction with her excellent “I Am Not A Robot” track, calling up the more vulnerably affirmative, “Don’t Give Up” Bush. But it’s her screwy, cuckooing “Mowgli’s Road” that effectively conjures up woozy Kate at a post-rave bonfire.

Half-Pakistani lovely Natasha Khan works the gleaming edge of Bush’s dark underworld glamour, and grounds her post-goth balladry and soft electro sparks in the sensual world. Her single “Daniel” de-Eltons the title character and places him among Bush’s slightly menacing, jig-footed cosmic effigies.

Mika Levi calls herself Micachu and spits out shiv-sharp blasts of dissonant micro-punk — seemingly the opposite of Bush’s epic dramas. But Levi echoes Bush both in the sheer Englishness of her lyrics, the knockout oddity of her instrumentation and starry-eyed gender-bending. Micachu’s rambunctious, exhilarating new album Jewelry (Rough Trade) could easily have been shaken out of Bush’s backing track outtake archives.

MOTHER STANDS FOR COMFORT: KATE BUSH IN THE SOUNDS OF NOW

It’s always exciting when you sense universal consciousness in motion. Like so many around me lately, I can’t stop listening to Kate Bush. I play Hounds Of Love (EMI, 1985) from start to finish again and again, allowing a different song from the album to become my theme or guiding light for weeks at a time. I play The Dreaming (EMI, 1982) and let it spin in and out of my head. These songs are as dramatic as they are sincere. They conjure magic while maintaining an emotional core. Bush’s undeniable integrity travels through her songs like a force of nature, from soft-lit soap opera to primal realms.

Many great records by other artists in the last few years have been stamped with undeniable Kate Bush moments. A new generation of musicians is learning that avant and pop sensibilities can coexist in exciting ways and that it is possible to blend the organic and the mechanical to create songs that soar with a mission. Here are some of today’s cloudbusters.

The debut solo record from Karin Dreijer Andersson of the Knife is more internal and intense than the dance floor stylings of her well-known group. Andersson plays with different voices and personas while creating sounds that are creepy and comforting. The result feels like a perfect contemporary response to Bush’s explorations of 20 years ago.

PREVIEW A torrent of questions arose amid the global mourning over Michael Jackson’s sudden passing. Was he addicted to prescription pain meds? How much was he actually worth? Did his father’s abuse scar the star beyond repair? Speaking of paternal influence, will 12-year-old Prince Michael Jackson follow his famous father’s musical calling? If he displays even an ounce of MJ’s talent, the pressure will be enormous.

A similar scenario played out in the African music world following the 2006 passing of Malian blues guitarist Ali Farka Touré from bone cancer. Farka Touré’s son Vieux expressed an early interest in music, but his father objected, hoping to shelter him from a professional musician’s grueling tour circuit. It didn’t work. Vieux picked up the guitar, releasing a self-titled debut on Modiba/World Village in late 2006, followed by the creative, youth-embracing Remixed: UFOs Over Bamako (Modiba) in 2007. With guidance from legendary Malian kora player Toumani Diabat, the younger Touré’s first two releases express a reverence for his father’s emotive, blues-soaked guitar style while exploring rock and electronic music interests.

These traditional and modern threads entwine so thoroughly that they fuse on the new Fondo (Six Degrees). Vieux gives voice to swirling Saharan dust storms on the energetic "Sarama," explores Mali’s quiet spirituality on "Paradise" (featuring Diabate’s kora solos) and ponders West African struggles in the 21st century on the reggae-tinged "Diaraby Magni." Like his father, Vieux’s music has taken him from Bamako, Mali to Bonnaroo, the massive Tennessee music festival where his American summer tour begins. As U.S. indie bands like Vampire Weekend and Fools Gold incorporate African rhythms into their repertoires, it’s worth hearing a talented African guitar hero whose taste for rock isn’t just skin deep, it’s in his DNA.

ESFAC’E: The face of pop culture, redefined

There are lifestyle brands. And then there are lifestyle brands. While the likes of Paris Hilton are “working” to expand their “businesses” in empowering consumers to turn heads with obnoxious celeb perfumes, Dele Sobomehin and his friends are running youth camps and making political statements with the most socially conscious fashion label in the Bay.

Sobomehin (“Dele” is short for “Oladele”) literally works in a brotherhood of friends and family as ESFAC’E’s first full-time employee. Sobomehin, his brother, and friends from Stanford and Santa Clara University founded the brand with a mission to make popular culture positive. And thus, in 2002, a movement was born.

ESFAC’E (pronounced “es-fah-chee”) is actually an acronym for the heart of their label’s movement: Education and Service through Fashion, Athletics, Community, and Entertainment. ESFAC’E’s urban-styled screened tees are just the face of their efforts.

What’s wrong with San Francisco?

EDITORIAL In the end, Mayor Gavin Newsom got his way. The San Francisco supervisors made some significant changes to the budget and saved some $40 million worth of programs that the mayor wanted to cut or privatize, but the Newsom for governor ads will still be able to proclaim that the mayor solved his city’s budget problem without raising taxes or cutting police and firefighters.

Instead, this fall some 1,500 city employees are slated to be laid off, 400 of them in the Department of Public Health. Many recreation directors will get pink slips. Human services will lose at least 100 people. Nonprofit service providers will see much of their city funding disappear. The money to pay for public financing of the upcoming supervisorial and mayoral races is gone. Newsom’s pet (and expensive) 311 service will still be open 24 hours a day (with a lot of the money coming from Muni).

Not one of the city’s hugely redundant fire stations will close, even for a few days at a time. The bloated police budget will see no significant cuts, and the cops and firefighters will still get raises. The mayor will continue to employ five people in his press office.

And the only new revenue in the budget comes from fee increases on Muni, public parks, after-school programs, street fairs, restaurants, and the like.

Sup. John Avalos, chair of the Budget and Finance Committee, told us this was the best deal the supervisors could get, and it’s true that the board forced Newsom to add back a lot of money he wanted to cut. But the committee stopped far short of doing what it should have done — fundamentally changing the priorities of the Newsom budget.

Campos told us that he had "mixed feelings" about the deal and expressed concern about the board’s ability to shape midyear cuts and the lack of commitment from Newsom to support support placing revenue measures on the November ballot. Mirkarimi said he was happy with the dollar amounts of the add-backs but proposed holding in reserve some funding for the mayor’s pet projects — a tool for ensuring that Newsom consults with supervisors on the midyear cuts as promised — but Avalos opposed the idea.

Avalos said he’s relying on Newsom’s commitment to him: "The mayor has given me the assurance that he will not make unilateral decisions." But Newsom has a history of breaking such promises.

And the supervisors have not included any new tax revenue in the budget projections. Which puts San Francisco far behind Oakland.

The Oakland City Council has plenty of problems, and the mayor of Oakland, Ron Dellums, has been missing in action on a lot of the city’s problems lately. But when the mayor and the council had to address the budget problems, they came up with a solution that includes at least $6 million in new taxes. While that sounds like a small number, it’s almost 10 percent of Oakland’s budget shortfall. And the new taxes, which will need voter approval in a special July 21 election, are included as part of the budget plan for fiscal 2009-10.

Two of the new taxes — a levy on pot clubs (which the clubs themselves strongly support) and a loophole-closing measure that forces big businesses to pay their fair share of real estate transfer taxes — require only a simple majority vote to take effect. The reason: the council voted unanimously to declare a fiscal emergency and put the measures on the ballot. That allowed the city to avoid the state law that requires a two-thirds vote on most new taxes.

Measures C, D, F, and H make up a generally progressive package that has the support of Council Members Rebecca Kaplan and Jean Quan and Rep. Barbara Lee. We’re happy to endorse all four.

Measure C is a 3 percent increase in the city’s hotel tax, which would rise from 11 percent to 14 percent. Half the new money would go to the Oakland Convention and Visitors Bureau while the other half would be split between the Oakland Zoo, the Chabot Space and Science Center, and cultural arts programs and festivals in the city. We could argue with the distribution (arts festivals should probably get more money and the Visitors Bureau less) but overall, it raises the hotel tax to the level of most other cities in the area and would raise money for the sorts of programs hotel taxes typically fund.

Measure D is a technical amendment to the Oakland Kids First law that mandates spending on programs for children and youth. It changes the spending requirement from 1.5 percent of total city revenues to 3 percent of the general fund. That’s slightly less money than the program currently gets, but a lot more than it has had over the past decade. The coalition that put Kids First on the ballot in 1996 (and modified it in 2008) supports this modest change.

Measure F is a creative new tax. It would impose a 1.8 percent gross receipts tax ($18 per $1,000 in sales) on medical marijuana businesses. Most efforts to hike business taxes face bitter opposition from business owners, but in this case, the pot clubs are happy to pay. In fact, the four dispensaries in Oakland are among the measure’s strongest supporters. Paying taxes tends to legitimize the clubs — and while it’s going to be tricky to track sales in what is still largely a cash business where records have in the past been kept vague to avoid the threat of federal prosecution, this is a strong step in the right direction.

Measure H would prevent big corporations from cheating Oakland out of real estate transfer taxes. Under current law, a business that owns property in Oakland and is bought by another business (or becomes part of a merger) doesn’t have to pay transfer taxes on the property it owns. Closing that loophole could bring in as much as $4.4 million a year.

There’s a lesson here for the much larger city across the Bay.

San Francisco desperately needs new revenue. And while the mayor has talked, in vague terms, about maybe supporting some sort of tax measures in November, he hasn’t committed to anything. There are several proposals floating around the board, the latest of which is a Labor Council-supported tax on alcohol consumption, but no coherent package. The progressives on the board — both those who support the compromise Newsom budget and those who don’t — need to set aside those differences, now, and get to work on finding ways to bring in enough new money to deal with the impacts of further state cuts and stave off some of the layoffs slated for the fall.

The main obstacles are Sups. Sean Elsbernd and Michela Alioto-Pier. Everyone who cares about saving services in this city needs to pressure them to back away from their GOP-style no-new-taxes stands. If those two would at least agree to let the voters decide on new revenue measures, the city would likely get a unanimous board — and the ability to raise taxes with a simple majority vote.

Oakland’s pot club tax and real estate transfer tax are great ideas that can be directly imported to San Francisco. The city’s business tax could be made more progressive (and bring in new revenue) with a simple change in the tax rates (higher on the big outfits, lower on the small ones). We’re dubious about a sales tax increase — even a half-percent hike would bring the local tax rate to 10 percent. And, even though the alcohol tax isn’t exactly progressive, those ideas could be acceptable as part of a package.

The main thing is that the city will need, at minimum, another $100 million this fall, and probably ought to be looking at raising twice that much. Oakland — a city with far fewer resources, a much smaller business base, and radically less wealth — is managing to fight its deficit with progressive taxes. What’s wrong with San Francisco?

P.S.: Sup. Chris Daly was outspoken in his criticism of the budget deal, blasting Newsom and even taking on his former aide and longtime ally, Avalos. But for all his bluster about the mayor, Daly couldn’t bring himself to oppose Anson Moran, Newsom’s nominee for the Public Utilities Commission. Moran was a staunch ally of Pacific Gas and Electric Co. when he was the PUC’s general manager, and the full board should reject him. *
