Guardian reporter’s inside story on arrested protesters

I thought I was keeping a safe distance, observing Day of Action protesters as they went onto Interstate 880 to block traffic rather than participating, until a line of riot cops came barreling towards where I stood by the side of a freeway offramp. But my flight instinct took over, and I found myself running along northbound 880 with my notebook and pen still in my hands. What had been an impressive but otherwise peaceful protest was taking a surreal turn. But maybe I should start from the beginning.

As a recent UC Berkeley grad, I had been on campus many times in the last few months, invited by friends to support the occupations and protests that were fueling an extraordinary movement to defend public education. So I was excited to go out on March 4th to cover the Day of Action in the East Bay. This was a new experience for me. Like any good Berkeley grad, I’ve participated in my share of protests, but now I was a Bay Guardian news intern and this was the first time I was going out as a reporter.

There was a lot to be impressed with that day. In Berkeley, activists had succeeded in creating a broad coalition made up of graduate and undergraduate students, faculty, union members, lecturers, and campus workers and staff. These constituencies were well-represented Thursday morning.

Berkeley organizers were also working to expand their movement beyond the university. Callie Maidhof, a graduate student in anthropology, told me that March 4th is the “first attempt to organize beyond a single system, to organize across California, across the public education systems, and across the nation.”

On the four and a half mile march from Berkeley to downtown Oakland, there was plenty of evidence that they were succeeding. As the Berkeley contingent marched down Telegraph Ave., it was joined by middle school and high school students who brought their own concerns about teacher layoffs and program cuts.

At the rally in Oakland, I spoke to high school students who had walked out of their schools to participate. Sophomore Sienee Dakina from Oakland’s Envision Academy told me that her school lost three teachers because of budget cuts. “We feel like it’s not right,” Dakina said. “We’re losing our teachers.” Ninth graders Victoria Romero and Andrea Barba from Life Academy told me that they were protesting so that the school district would “not take our dreams away.”

When the rally ended, some people were headed to San Francisco to take part in the big rally at Civic Center. I knew that there would already be Guardian reporters there, so I decided to stay in Oakland for what was being billed as an after-protest dance party and “snake march.”

The dance party started around 4:30 with a couple hundred people taking Broadway accompanied by a mobile sound system, black flags, and large banners that declared “We Have Decided Not to Die” and “Occupy Everything.” For the first time that day, I saw riot cops in full force. I read these as signs that something dramatic was probably in store. The dance party wound its way through downtown Oakland, stopping in front of the UC Office of the President before heading towards West Oakland.

I was at the back of the march, talking to an Oakland teacher who was telling me about layoffs at his school, when the police started warning the crowd that they could face arrest. I fell behind and was playing catch-up as a group of around 150 people took to the freeway. I decided to stick by the offramp and watched as a bicyclist, who appeared to be riding on the freeway away from the march, got violently tackled by a fast-moving line of cops.

It was at this point that another line of cops started up the offramp and I fled up the freeway. An officer on a motorcycle yelled at me to continue and join the protesters or face arrest. I ran to catch up with the crowd, which was in chaos as the police approached. (I later learned that, in the chaos, a local high school student fell off the elevated highway and was taken to Highland Hospital with serious injuries.) I saw two kids – perhaps as young as 12 or 13 – trying to get away on skateboards. I was with a cluster of journalists as a line of cops and a blur of batons fell upon a group on the far side of the southbound lanes. We retreated to the dividing wall, me still clutching my pen and notebook, holding my hands in the air.

We were ordered to lay on the ground. My pen was still out so I continued taking notes. An officer noticed me and ordered me up. I explained that I was a reporter and offered to show him proof of my affiliation with the Guardian. “But you’re on a freeway,” he said. “You’re under arrest.” He did help me secure my notes and camera.

I was handcuffed and ordered to kneel on the side of the highway with the protesters, next to a friend from Berkeley, a graduate student at the journalism school. We knelt for hours waiting for the buses that would take us to Glenn Dyer jail in Oakland and Santa Rita jail in Dublin. A handful of stranded motorists cheered, presumably for the protesters, and in one of the lofts next to the freeway, a resident had posted a sign that said “FUCK U Protesters.”

I was sent to Santa Rita with around 100 of those arrested on the freeway. We were informed that we would be charged with misdemeanors and released, but it was clear that our numbers had overwhelmed the jail’s systems. Deputies told us that we would be in there for 10 hours. Ten hours turned into 20, most of that time spent in a cold concrete cell, seven feet long and seven feet wide, with 14 other inmates. There wasn’t room for all of us to lie down at the same time. The fluorescent lights were kept on all night, and I was disoriented, groggy.

The sheriff’s deputies joked about IEDs and half-heartedly threatened us with prison clichés. An agent with U.S. Immigration and Customs Enforcement visited my cell and questioned me and another person of color, asking us for our names and where we were born. My cell mates, worried about the possibility that an undocumented student had been arrested, discussed whether we should refuse to answer their questions. An inmate in a nearby cell hurled obscenities at the “protesters.” But most of the other inmates were merely curious. A few held up their fists in solidarity as they were led past our cell.

I shared cells with a diverse group of people, some I had known for years: a teacher’s aid, a Berkeley freshman computer science major, a veteran, an older man who called himself a communist, and a handful of community college students from Modesto. There were a number of other journalists: two stringers working for Democracy Now!, a reporter from the Daily Californian, and a friend who was covering the protest for Indybay.org. I had seen other journalists with big video rigs on the freeway, but one of the other arrestees told me that they had been allowed to leave.

We passed the time as best we could. The Berkeley computer science major taught us how to fold origami cranes. One of the other reporters gave an impromptu teach-in about some Bay Area residents imprisoned in Iran. We took advantage of the concrete cell’s unique acoustic properties by humming harmonies. A few cells over, the women agitated for food and we got bologna sandwiches and a strange powdered juice that tasted like the color yellow. Mostly, we tried to sleep, in fetal positions, sitting up, or curled around the toilet using our arms, shoes, and rolls of TP for pillows.

There were also discussions about the movement: how to make it broader, how best to organize and make decisions, and what should come next. It was clear to me that many of the people I was with did not know that they would end up on a freeway, but if there were any regrets, no one in my cell let that on. One man commented that the movement was getting bigger – earlier protests had resulted in dozens of arrests, but this one had 150 people taking a freeway. Another said that only the movement “intellectuals” were taking militant action. A community college student objected to that point. Earlier, he had joked about the $6 increase in his fees, but now he spoke bitterly and passionately about how he considered himself working class and not an intellectual. The budget cuts had made him feel that a quality education at a UC was getting further from his grasp.

I was not released until around 4 p.m. on Friday, charged with two misdemeanors – unlawful assembly and obstructing a public place – and ordered to appear in court April 5. Outside the jail, a small crowd of supporters had been gathered all day and it did not take long to find a familiar face and a ride back home.

A friend who had worked through the night to rally support and secure attorneys told me that a lot of students were upset about what had happened. They were critical about what they called a lack of planning and angry that protesters had been led into an action they did not fully understand and did not fully prepare for.

But the freeway action also showed how far the movement has come. Resistance to the budget cuts has spilled out of the universities and gotten bigger, broader, and, yes, perhaps more foolhardy. From my vantage point on that elevated highway, the movement has definitely upped the ante and more and more people are calling the bet.

Brooklyn’s Finest "Really? I mean, really?" asked the moviegoer beside me as the final freeze-frame of Brooklyn’s Finest slapped our eyeballs. Yes, that’s the sound of letdown, despite the fact that Brooklyn’s Finest initially resembled a promisingly gritty juggling act in the mode of The Wire and Cop Land (1997), Taxi Driver (1976) and Training Day (2001). Bitter irony flows from the title — and from the lives, loves, bad habits, pressure-cooker stress, and unavoidable moral dilemmas of three would-be everyday cops, all occupying several different rungs on a food chain where right and wrong have an unpleasant way of switching sides. Eddie (Richard Gere) is the veteran officer just biding his time till he gets his pension, all while comforting himself with the meager sensuous attentions of hooker Chantel (Shannon Kane). Sal (Ethan Hawke) is the bad detective, stealing from the dealers to fund a dream home for his growing family with Angela (Lili Taylor). Tango (Don Cheadle) is the undercover detective who has cultivated friendships with dealers like Caz (Wesley Snipes) and sacrificed his marriage for a long-promised promotion from his lieutenant (Will Patton) and his superior (Ellen Barkin, in likely the most misogynist portrayal of a lady with a badge to date). You spend most of Brooklyn’s Finest waiting for these cops to collide in the most unfortunate, messiest way possible, but instead the denouement leaves will leave one wondering about unresolved threads and feeling vaguely unsatisfied. In any case, director Antoine Fuqua and company seem to pride themselves on their tough-minded if at times cartoonish take on law enforcement, with Hawke in particular turning in a memorably OTT and anguished performance. The Yellow Handkerchief The Yellow Handkerchief is one of those quiet, character-driven dramas that get mistaken for subtle classics. It’s not bad, just bland. In fact, there’s something pleasant about the way the film’s three unlikely friends forge a lasting bond, but the movie as a whole is never quite that cohesive. William Hurt stars as Brett Hanson, an ex-con with a dark past. (The Yellow Handkerchief tries to make this mysterious by way of vague flashbacks, but the audience gets there faster than the film does.) His inadvertent sidekicks are the troubled Martine (Kristen Stewart) and the awkward Gordy (Eddie Redmayne). The talented cast, rounded out by Maria Bello as the wife Brett left behind, does solid work with the material, but no one really stands out enough to elevate The Yellow Handkerchief to greatness. Redmayne is perhaps the most impressive, ditching his British accent to play a character so quirky, he’s almost Rain Man. But after taking a step back, the big picture is muddled. People are fascinating, but what does it all mean? (1:36) Albany. (Peitzman)

*"Academy Award-Nominated Short Films: Animated" Just because it’s animation doesn’t mean it’s just for kids. Like the live-action Oscar-nominated shorts, this year’s animated selections have got range, from the traditionally child-friendly to downright vulgar. Skewing heavily towards CG fare, the shorts vary from a Looney Tunes-style chase for an elderly woman’s soul (The Lady and the Reaper) to the Wallace and Gromit BBC special, A Matter of Loaf and Death. Most entertaining by far is Logorama, an action-packed tale set in a world populated by familiar trademarked logos. Any film that casts the Michelin man as a garbage-mouthed cop on the case of a renegade Ronald McDonald deserves to win all the awards in the universe. (1:35) Opera Plaza, Shattuck. (Galvin)

*"Academy Award-Nominated Short Films: Live Action" Aren’t you tired of wondering what all the fuss is about when the Academy awards their Oscar for Best Short? In an effort to give audiences a chance to play along, Shorts International is screening these less-seen works together. Though one or two of the five nominated films threaten to adhere to the Academy’s penchant for either heartbreaking or heartwarming, the majority are surprisingly oddball picks. Perhaps most odd of all is Denmark/U.S. submission The New Tenants. Feeling a tad forced but no less funny for it, Tenants draws on celebrities like Vincent D’Onofrio and comedian Kevin Corrigan to bring life to this surreal adaptation by Anders Thomas Jensen (2006’s After the Wedding). My pick would be Sweden’s gloriously goofy Instead of Abracadabra, which stars a stay-at-home slacker as he puts on a magic show for his father’s birthday. Obviously, some selections are going to be better than others, but hey, they’re shorts. If you don’t like one, just wait 10 minutes and you’ll find yourself somewhere completely different. Avatar James Cameron’s Avatar takes place on planet Pandora, where human capitalists are prospecting for precious unobtainium, hampered only by the toxic atmosphere and a profusion of unfriendly wildlife, including the Na’vi, a nine-foot tall race of poorly disguised cliches. When Jake Sully (Sam Worthington), a paraplegic ex-marine, arrives on the planet, he is recruited into the "Avatar" program, which enables him to cybernetically link with a part-human, part-Na’vi body and go traipsing through Pandora’s psychedelic underbrush. Initially designed for botanical research, these avatars become the only means of diplomatic contact with the bright-blue natives, who live smack on top of all the bling. The special effects are revolutionary, but the story that ensues blends hollow "noble savage" dreck with events borrowed from Dances With Wolves (1990) and FernGully: The Last Rainforest (1992). When Sully falls in love with a Na’vi princess and undergoes a spirit journey so he can be inducted into the tribe and fight the evil miners, all I could think of was Kevin Bacon getting his belly sliced in The Air Up There (1994). The Blind Side When the New York Times Magazine published Michael Lewis’ article "The Ballad of Big Mike" — which he expanded into the 2006 book The Blind Side: Evolution of a Game — nobody could have predicated the cultural windfall it would spawn. Lewis told the incredible story of Michael Oher — a 6’4, 350-pound 16-year-old, who grew up functionally parentless, splitting time between friends’ couches and the streets of one of Memphis’ poorest neighborhoods. As a sophomore with a 0.4 GPA, Oher serendipitously hitched a ride with a friend’s father to a ritzy private school across town and embarked on an unbelievable journey that led him into a upper-class, white family; the Dean’s List at Ole Miss; and, finally, the NFL. The film itself effectively focuses on Oher’s indomitable spirit and big heart, and the fearless devotion of Leigh Anne Tuohy, the matriarch of the family who adopted him (masterfully played by Sandra Bullock). While the movie will delight and touch moviegoers, its greatest success is that it will likely spur its viewers on to read Lewis’ brilliant book. (2:06) Oaks. (Daniel Alvarez)

Broken Embraces Pedro Almodóvar has always dabbled in the Hitchcockian tropes of uxoricide, betrayal, and double-identity, but with Broken Embraces he has attained a polyglot, if slightly mimicking, fluency with the language of Hollywood noir. A story within a story and a movie within a movie, Embraces begins in the present day with middle-aged Catalan Harry Caine (Lluís Homar), a blind screenwriter who takes time between his successful writing career to seduce and bed young women sympathetic to his disability. "Everything’s already happened to me," he explains to his manager, Judit (Blanca Portillo). "All that’s left is to enjoy life." But this life of empty pleasures is brought to a sudden halt when local business magnate Ernesto Martel (José Luis Gómez) has died; soon after, Ernesto Jr. (Rubén Ochandiano), who has renamed himself Ray X, visits Caine with an unusual request. The action retreats 14 years when Caine was a young (and visually abled) director named Mateo Blanco; he encounters a breathtaking femme fatale, Lena (Penelope Cruz) — an actress-turned-prostitute named Severine, turned secretary-turned-trophy wife of Ernesto Martel — when she appears to audition for his latest movie. If all of the narrative intricacies and multiplicitous identities in Broken Embraces appear a bit intimidating at first glance, it is because this is the cinema of Almodóvar taken to a kind of generic extreme. As with all of the director’s post-’00 films, which are often referred to as Almodóvar’s "mature" pictures, there is a microscopic attention to narrative development combined with a frenzied sub-plotting of nearly soap-operatic proportions. But, in Embraces, formalism attains such prominence that one might speculate the director is simply going through the motions. The effect is a purposely loquacious and overly-dramatized performance that pleasures itself as much by setting up the plot as unraveling it. (2:08) Opera Plaza, Smith Rafael. (Morse)

Cop Out I think there was a plot to Cop Out — something involving a stolen baseball card and a drug ring and Jimmy (Bruce Willis) trying to pay for his daughter’s wedding. Frankly, it’s irrelevant. Kevin Smith’s take on the buddy cop genre, which partners Willis with Tracy Morgan, is more a string of dick jokes and toilet humor than anything else. Not that there’s anything wrong with that. Sometimes it’s nice to sit back and turn off your brain, as Morgan’s Paul describes his bowel movements or when hapless thief Dave (Seann William Scott) begins imitating everything our heroes say. At the same time, Cop Out is easily forgettable: Smith directed the film, but writing duties went to the Cullen Brothers of TV’s Las Vegas. All judgments about that series aside, the script lacks Smith’s trademark blend of heart and vulgarity. Even Mallrats (1995) had a beginning, a middle, and a satisfying end. Without Smith as auteur, Cop Out is worth a few laughs but destined for the bargain bin. (1:50) Oaks, 1000 Van Ness. (Peitzman)

The Crazies Disease and anti-government paranoia dovetail in this competent yet overwhelmingly non-essential remake of one of George A. Romero’s second-tier spook shows. In a small Iowa hamlet overseen by a benevolent sheriff (Timothy Olyphant) and his pregnant wife (Radha Mitchell), who’s also the town doctor, a few odd incidents snowball into all-out chaos when a mysterious, unmarked plane crashes into the local water supply. Before long, the few residents who aren’t acting like homicidal maniacs are rounded up by an uber-aggressive military invasion. Though our heroes convey frantic panic as they try to figure out what the hell is going on, The Crazies never achieves full terror mode. It’s certainly watchable, and even enjoyable at times. But memorable? Not in the slightest. (1:41) 1000 Van Ness. (Eddy)

Crazy Heart "Oh, I love Jeff Bridges!" is the usual response when his name comes up every few years for Best Actor consideration, usually via some underdog movie no one saw, and the realization occurs that he’s never won an Oscar. The oversight is painful because it could be argued that no leading American actor has been more versatile, consistently good, and true to that elusive concept "artistic integrity" than Bridges over the last 40 years. It’s rumored Crazy Heart was slotted for cable or DVD premiere, then thrust into late-year theater release in hopes of attracting Best Actor momentum within a crowded field. Lucky for us, this performance shouldn’t be overlooked. Bridges plays "Bad" Blake, a veteran country star reduced to playing bars with local pickup bands. His slide from grace hasn’t been helped by lingering tastes for smoke and drink, let alone five defunct marriages. He meets Jean (Maggie Gyllenhaal), freelance journalist, fan, and single mother. They spark; though burnt by prior relationships, she’s reluctant to take seriously a famous drunk twice her age. Can Bad handle even this much responsibility? Meanwhile, he gets his "comeback" break in the semi-humiliating form of opening for Tommy Sweet (Colin Farrell) — a contemporary country superstar who was once Bad’s backup boy. Tommy offers a belated shot at commercial redemption; Jean offers redemption of the strictly personal kind. There’s nothing too surprising about the ways in which Crazy Heart both follows and finesses formula. You’ve seen this preordained road from wreckage to redemption before. But actor turned first-time director Scott Cooper’s screenplay honors the flies in the windshield inherited from Thomas Cobb’s novel — as does Bridges, needless to say. Dear John As long as you know what you’re getting yourself into, Dear John is a solid effort. Not extraordinary by any means, it’s your standard Nicholas Sparks book-turned-film: boy meets girl — drama, angst, and untimely death ensue. Here, Channing Tatum stars at the titular John, a soldier on leave who falls in love with the seemingly perfect Savannah (Amanda Seyfried). Both actors are likable enough that their romance is charming, if not always believable. And Dear John‘s plot turns, while not quite surprising, are at least dynamic enough to keep the audience engaged. But at the end of the day, this is still a Nicholas Sparks movie — even with the accomplished Lasse Hallström taking over directorial responsibilities. There are still plenty of eye-roll moments and, more often than not, Dear John employs the most predictable tearjerking techniques. By the time you realize why the film is set in 2001, it’s September 11. Sad? Surely. Cheap? You betcha. (1:48) 1000 Van Ness, SF Center. (Peitzman)

Edge of Darkness (1:57) SF Center.

*An Education The pursuit of knowledge — both carnal and cultural — are at the tender core of this end-of-innocence valentine by Danish filmmaker Lone Scherfig (who first made her well-tempered voice heard with her 2000 Dogme entry, Italian for Beginners), based on journalist Lynn Barber’s memoir. Screenwriter Nick Hornby breaks further with his Peter Pan protagonists with this adaptation: no man-boy mopers or misfits here. Rather, 16-year-old schoolgirl Jenny (Carey Mulligan) is a good girl and ace student. It’s 1961, and England is only starting to stir from its somber, all-too-sober post-war slumber. The carefully cloistered Jenny is on track for Oxford, though swinging London and its high-style freedoms beckon just around the corner. Ushering in those freedoms — a new, more class-free world disorder — is the charming David (Peter Sarsgaard), stopping to give Jenny and her cello a ride in the rain and soon proffering concerts and late-night suppers in the city. He’s a sweet-faced, feline outsider: cultured, Jewish, and given to playing fast and loose in the margins of society. David can see Jenny for the gem she is and appreciate her innocence with the knowing pleasure of a decadent playing all the angles. The stakes are believably high, thanks to An Education‘s careful attention to time and place and its gently glamored performances. Scherfig revels in the smart, easy-on-eye curb appeal of David and his friends while giving a nod to the college-educated empowerment Jenny risks by skipping class to jet to Paris. And Mulligan lends it all credence by letting all those seduced, abandoned, conflicted, rebellious feelings flicker unbridled across her face. *Fish Tank There’s been a string of movies lately pondering what Britney once called the not-a-girl, not-yet-a-woman syndrome, including 2009’s An Education and Precious: Based on the Novel Push By Sapphire. Enter Fish Tank, the gritty new drama from British filmmaker Andrea Arnold. Her films (including 2006’s Red Road) are heartbreaking, but in an unforced way that never feels manipulative; her characters, often portrayed by nonactors, feel completely organic. Fish Tank‘s 15-year-old heroine, Mia (played by first-time actor Katie Jarvis), lives with her party-gal single mom and tweenage sister in a public-housing high-rise; all three enjoy drinking, swearing, and shouting. But Mia has a secret passion: hip-hop dancing, which she practices with track-suited determination. When mom’s foxy new boyfriend, Connor (Michael Fassbender, from 2008’s Hunger) encourages her talent, it’s initially unclear what Connor’s intentions are. Is he trying to be a cool father figure, or something far more inappropriate? Without giving away too much, it’s hard to fear too much for a girl who headbutts a teenage rival within the film’s first few minutes — though it soon becomes apparent Mia’s hard façade masks a vulnerable core. Her desire to make human connections causes her to drop her guard when she needs it the most. In a movie about coming of age, a young girl’s bumpy emotional journey is expected turf. But Fish Tank earns its poignant moments honestly — most coming courtesy of Jarvis, who has soulfullness to spare. Whether she’s acting out in tough-girl mode or revealing a glimpse of her fragile inner life, Arnold’s camera relays it all, with unglossy matter-of-factness. (2:02) Smith Rafael. (Eddy)

Formosa Betrayed The turbulent modern history of Taiwan is certainly deserving of increased international attention, but writer-producer Will Tao’s strategy of structuring Formosa Betrayed as a political thriller is too often at odds with imparting facts and information. Set in the early 80s, the film thrusts viewers into an unraveling government conspiracy that has FBI agent Jake Kelly (James Van Der Beek) trailing the suspected murderers of a Chicago professor to Taipei. Initially, selling Dawson’s Creek alum Van Der Beek as an FBI agent seems a strange choice, but undoubtedly his name will fill seats, and Formosa Betrayed is shooting for maximum awareness. There are some scenes of real tension, but just when you are beginning to get wrapped up in the inherent drama of conspiracy and murder, the suspense is interrupted by a long-winded bout of soapboxing. Formosa Betrayed might enlighten some audiences about Taiwan’s controversial history, but it too often does so at the expense of its own watchability. You start to wonder why Tao didn’t just make a documentary. (1:43) SF Center, Shattuck. (Galvin)

From Paris with Love Every so often, I walk out of a film feeling like I’ve been repeatedly buffeted by blows to the face. Transformers 2: Revenge of the Fallen (2009) had this effect, and it is now joined by From Paris With Love, a movie so aggressively stupid that the mistaken assumption that it was adapted from a video game could be construed as an insult to video games. John Travolta shows up chrome-domed as Charlie Wax, a loose-cannon CIA operative with a lot of transparently screenwritten machismo and an endless appetite for violence. He is joined by Jonathan Rhys Meyers, sporting a risible American accent, and the two embark on a frantic journey across the French capital that is almost as racist as it is misogynistic. I could fill an entire issue of this newspaper eviscerating this movie —suffice to say, don’t see it. (1:35) SF Center. (Richardson)

*The Ghost Writer Roman Polanski’s never-ending legal woes have inspired endless debates on the interwebs and elsewhere; they also can’t help but add subtext to the 76-year-old’s new film, which is chock full o’ anti-American vibes anyway. It’s also a pretty nifty political thriller about a disgraced former British Prime Minister (Pierce Brosnan) who’s hanging out in his Martha’s Vineyard mansion with his whip-smart, bitter wife (Olivia Williams) and Joan Holloway-as-ice-queen assistant (Kim Cattrall), plus an eager young biographer (Ewan McGregor) recently hired to ghost-write his memoirs. But as the writer quickly discovers, the politician’s past contains the kinds of secrets that cause strange cars with tinted windows to appear in one’s rearview mirror when driving along deserted country roads. Polanski’s long been an expert when it comes to escalating tension onscreen; he’s also so good at adding offbeat moments that only seem tossed-off (as when the PM’s groundskeeper attempts to rake leaves amid relentless sea breezes) and making the utmost of his top-notch actors (Tom Wilkinson and Eli Wallach have small, memorable roles). Though I found The Ghost Writer‘s ZOMG! third-act revelation to be a bit corny, I still didn’t think it detracted from the finely crafted film that led up to it. The Hurt Locker When the leader of a close-knit U.S. Army Explosive Ordnance Disposal squad is killed in action, his subordinates have barely recovered from the shock when they’re introduced to his replacement. In contrast to his predecessor, Sgt. James (Jeremy Renner) is no standard-procedure-following team player, but a cocky adrenaline junkie who puts himself and others at risk making gonzo gut-instinct decisions in the face of live bombs and insurgent gunfire. This is particularly galling to next-in-command Sanborn (Anthony Mackie). An apolitical war-in-Iraq movie that’s won considerable praise for accuracy so far from vets (scenarist Mark Boal was "embedded" with an EOD unit there for several 2004 weeks), Kathryn Bigelow’s film is arguably you-are-there purist to a fault. While we eventually get to know in the principals, The Hurt Locker is so dominated by its seven lengthy squad-mission setpieces that there’s almost no time or attention left for building character development or a narrative arc. The result is often viscerally intense, yet less impactful than it would have been if we were more emotionally invested. Assured as her technique remains, don’t expect familiar stylistic dazzle from action cult figure Bigelow (1987’s Near Dark, 1989’s Blue Steel, 1991’s Point Break) — this vidcam-era war movie very much hews to the favored current genre approach of pseudo-documentary grainy handheld shaky-cam imagery. Invictus Elected President of South Africa in 1995 — just five years after his release from nearly three decades’ imprisonment — Nelson Mandela (Morgan Freeman) perceives a chance to forward his message of reconciliation and forgiveness by throwing support behind the low-ranked national rugby team. Trouble is, the Springboks are currently low-ranked, with the World Cup a very faint hope just one year away. Not to mention the fact that despite having one black member, they represent the all-too-recent Apartheid past for the country’s non-white majority. Based on John Carlin’s nonfiction tome, this latest Oscar bait by the indefatigable Clint Eastwood sports his usual plusses and minuses: An impressive scale, solid performances (Matt Damon co-stars as the team’s Afrikaaner captain), deft handling of subplots, and solid craftsmanship on the one hand. A certain dull literal-minded earnestness, lack of style and excitement on the other. Anthony Peckham’s screenplay hits the requisite inspirational notes (sometimes pretty bluntly), but even in the attenuated finals match, Eastwood’s direction is steady as she goes — no peaks, no valleys, no faults but not much inspiration, either. It doesn’t help that Kyle Eastwood and Michael Stevens contribute a score that’s as rousing as a warm milk bath. This is an entertaining history lesson, but it should have been an exhilarating one. *The Last Station Most of the buzz around The Last Station has focused on Helen Mirren, who takes the lead as the Countess Sofya, wife of Leo Tolstoy (Christopher Plummer). Mirren is indeed impressive — when is she not? — but there’s more to the film than Sofya’s Oscar-worthy outbursts. The Last Station follows Valentin Bulgakov (James McAvoy), hired as Tolstoy’s personal secretary at the end of the writer’s life. Valentin struggles to reconcile his faith in the anarchist Christian Tolstoyan movement with his sympathy for Sofya and his budding feelings for fellow Tolstoyan Masha (Kerry Condon). For the first hour, The Last Station is charming and very funny. Once Tolstoy and Sofya’s relationship reaches its most volatile, however, the tone shifts toward the serious — a trend that continues as Tolstoy falls ill. After all the lighthearted levity, it’s a bit jarring, but the solid script and accomplished cast pull The Last Station together. Paul Giamatti is especially good as Vladimir Chertkov, who battles against Sofya for control of Tolstoy’s will. You’ll never feel guiltier for putting off War and Peace. *Leonard Cohen: Live at the Isle of Wight 1970 The dawn of the Me Decade saw the largest-ever music festival to that date —albeit one that was such a logistical, fiscal and hygenic disaster that it basically killed the development of similar events for years. This was the height of "music should be free" sentiments in the counterculture, with the result that many among the estimated six to eight hundred thousand attendees who overwhelmed this small U.K. island showed up without tickets, refused to pay, and protested in ways that included tearing down barrier walls and setting fires. It was a bummer, man. But after five days of starry acts often jeered by an antsy crowd — including everyone from Joni, Hendrix, Dylan, Sly Stone, the Who and the Doors to such odd bedfellows as Miles Davis, Tiny Tim, Voices of East Harlem, Supertramp, and Gilberto Gil — Canadian troubador Cohen appeared at 4 a.m. on a Monday to offer balm. Like director Murray Lerner’s 1995 Message to Love, about the festival as a whole, this footage has been shelved for decades, but it bounces right back from the dead — albeit soothingly. Cohen seems blissed out, pupils like black marbles, his between-song musings are as poetical as those fascinating lyrics, and his voice is suppler than the rasp it would soon become. Kris Kristofferson, Judy Collins, Joan Baez, and bandmate Bob Johnson offer reflections 40 years later. But the main attraction is obviously Cohen, who is magnetic even if an hour of (almost) nothing but ballads reveals how stylistically monotone his songwriting could be. (1:04) Roxie. (Harvey)

*The Most Dangerous Man in America: Daniel Ellsberg and the Pentagon Papers For many, Daniel Ellsberg is a hero — a savior of American First Amendment rights and one of the most outspoken opponents of the Vietnam war. But as this documentary (recently nominated for an Academy Award) shows, it’s never an an easy decision to take on the U.S. government. Ellsberg himself narrates the film and details his sleepless nights leading up to the leak of the Pentagon Papers — the top secret government study on the Vietnam war — to the public. Though there are few new developments in understanding the particulars of the war or the impact the release of the Papers had on ending the conflict, the film allows audiences to experience the famous case from Ellsberg’s point of view, adding a fresh and poignantly human element to the events; it’s a political documentary that plays more like a character drama. Whether you were there when it happened or new to the story, there is something to be appreciated from this tale of a man who fell out of love with his country and decided to do something about it. *North Face You’ll never think of outerwear the same way again — and in fact you might be reaching for your fleece and shivering through the more harrowing climbing scenes of this riveting historical adventure based on a true tale. Even those who consider themselves less than avid fans of outdoor survival drama will find their eyes frozen, if you will, on the screen when it comes to this retelling/re-envisioning of this story, legendary among mountaineers, of climbers, urged on by Nazi propaganda, to tackle the last "Alpine problem." At issue: the unclimbed north face of Switzerland’s Eiger, a highly dangerous and unpredictable zone aptly nicknamed "Murder Wall." Two working-class friends, Toni Kurz (Benno Fürmann of 2008’s Jerichow) and Andi Hinterstoisser (Florian Lukas) — here portrayed as climbing fiends driven to reach summits rather than fight for the Nazis — take the challenge. There to document their achievement, or certain death, is childhood friend and Kurz’s onetime sweetheart Luise (Johanna Wokalek, memorable in 2008’s The Baader Meinhof Complex), eager to make her name as a photojournalist while fending off the advances of an editor (Ulrich Tukur) seeking to craft a narrative that positions the contestants as model Aryans. But the climb — and the Eiger, looming like a mythical ogre — is the main attraction here. Filmmaker Philipp Stölzl brings home the sheer heart-pumping exhilaration and terror associated with the sport — and this specific, legendarily tragic climb — by shooting in the mountains with his actors and crew, and the result goes a way in redeeming an adventure long-tainted by its fascist associations. *Percy Jackson and the Olympians: The Lightning Thief It would be easy to dismiss Percy Jackson and the Olympians: The Lightning Thief as an unabashed Harry Potter knock-off. Trio of kids with magic powers goes on a quest to save the world in a Chris Columbus adaptation of a popular young adult series — sound familiar? But The Lightning Thief is sharp, witty, and a far cry from Columbus’ joyless adaptation of Harry Potter and the Sorcerer’s Stone (2001). Logan Lerman stars as Percy Jackson, the illegitimate son of Poseidon and Catherine Keener. Once he learns his true identity at Camp Half-Blood, he sets off on a quest with his protector, a satyr named Grover, and potential love interest Annabeth, daughter of Athena. Along the way, they bump into gods and monsters from Greek mythology — with a twist. Think Percy using his iPhone to fight Medusa (Uma Thurman), or a land of the Lotus-Eaters disguised as a Lady Gaga-blasting casino. A worthy successor to Harry Potter? Too soon to say, but The Lightning Thief is at least a well-made diversion. (1:59) 1000 Van Ness. (Peitzman)

*Precious: Based on the Novel Push By Sapphire This gut-wrenching, little-engine-that-could of a film shows the struggles of Precious, an overweight, illiterate 16-year-old girl from Harlem. Newcomer Gabourey Sidibe is so believably vigilant that her performance alone could bring together the art-house viewers as well as take the Oscars by storm. But people need to actually go and experience this film. While Precious did win Sundance’s Grand Jury and Audience Award awards this year, there is a sad possibility that filmgoers will follow the current trend of "discussing" films that they’ve actually never seen. The daring casting choices of comedian Mo’Nique (as Precious’ all-too-realistically abusive mother) and Mariah Carey (brilliantly understated as an undaunted and dedicated social counselor) are attempts to attract a wider audience, but cynics can hurdle just about anything these days. What’s most significant about this Dancer in the Dark-esque chronicle is how Damien Paul’s screenplay and director Lee Daniels have taken their time to confront the most difficult moments in Precious’ story –- and if that sounds heavy-handed, so be it. Stop blahging for a moment and let this movie move you. (1:49) Presidio, Roxie, Shattuck. (Jesse Hawthorne Ficks)

*"Red Riding Trilogy" There’s a "wolf" of sorts and several unfortunate little girls, but no fairy tale whimsy whatsoever in this trilogy of features originally made for U.K. broadcast. Based on David Pearce’s literary mystery quartet (the second volume goes unadapted here), it’s a complicated dive into conspiracy, cover-up, and murder in England’s North Country. Directed by Julian Jarrold (2008’s Brideshead Revisited), first installment Red Riding: 1974 centers on ambitious young journalist Eddie (Andrew Garfield), who at first sees a string of abducted, then grotesquely mutilated children as a career-making opportunity. The deeper in he gets, though, the more troubling are the case’s murky connections to police and private-sector corruption. 1980, directed by James Marsh (2008’s Man on Wire), finds a new protagonist in Hunter (Paddy Considine). Now local fears are focused on the "Yorkshire Ripper" a savage (real-life) killer of at least 13 women between 1975 and 1981 whose so-far hapless police investigation Hunter has been assigned to audit. Finally, 1983 (directed by Anand Tucker of 2005’s Shopgirl) divides its attention between Yorkshire chief detective Jobson (David Morrissey) and low-rent lawyer Piggot (Mark Addy). After the first copycat child slaying in years occurs, both become convinced a mentally challenged man (Daniel Mays) was framed for the original murders. The nearly six hours this serpentine tale takes can’t help but impress as a weighty experience (at least on your posterior), and it’s duly won some sky-high critical acclaim ("better than the Godfather trilogy", etc.) Certainly Red Riding is rich in period detail, fine characterizations, and bleak atmospherics. But the cumulative satisfaction expected of a true epic is broken up by the sole ongoing characters being supporting ones — heroes who eventually "know too much" don’t survive long. In each segment (Marsh’s Super-16-shot one being most stylistically distinctive), women deployed as romantic interests seem largely superfluous. The whole fussy, cipherous narrative points toward a heart of jet-black darkness its climactic revelations are at once too banal and implausible to deliver. So, worthwhile? Yes, if you’ve got the time to spare. A hype-justifying masterpiece? No. (1974, 1:45; 1980, 1:36; 1983, 1:44) Lumiere. (Harvey)

Shutter Island Director Martin Scorsese and muse du jour Leonardo DiCaprio draw from oft-filmed novelist Dennis Lehane (2003’s Mystic River, 2007’s Gone Baby Gone) for this B-movie thriller that, sadly, offers few thrills. DiCaprio’s a 1950s U.S. marshal summoned to a misty island that houses a hospital for the criminally insane, overseen by a doctor (Ben Kingsley) who believes in humane, if experimental, therapy techniques. From the get-go we suspect something’s not right with the G-man’s own mind; as he investigates the case of a missing patient, he experiences frequent flashbacks to his World War II service (during which he helped liberate a concentration camp), and has recurring visions of his spooky dead wife (Michelle Williams). Whether or not you fall for Shutter Island‘s twisty game depends on the gullibility of your own mind. Despite high-quality performances and an effective, if overwrought, tone of certain doom, Shutter Island stumbles into a third act that exposes its inherently flawed and frustrating storytelling structure. If only David Lynch had directed Shutter Island — it could’ve been a classic of mindfuckery run amok. Instead, Scorsese’s psychological drama is sapped of any mystery whatsoever by its stubbornly literal conclusion. (2:18) California, Four Star, 1000 Van Ness, Presidio. (Eddy)

A Single Man In this adaptation of Christopher Isherwood’s 1964 novel, Colin Firth plays George, a middle-aged gay expat Brit and college professor in 1962 Los Angeles. Months after the accidental death of Jim (Matthew Goode), his lover for 16 years, George still feels worse than bereft; simply waking each morning is agony. So on this particular day he has decided to end it all, first going through a series of meticulous preparations and discreet leave-takings that include teaching one last class and having supper with the onetime paramour (Julianne Moore) turned best friend who’s still stuck on him. The main problem with fashion designer turned film director Tom Ford’s first feature is that he directs it like a fashion designer, fussing over surface style and irrelevant detail in a story whose tight focus on one hard, real-world thing — grief — cries for simplicity. Not pretentious overpackaging, which encompasses the way his camera slavers over the excessively pretty likes of Nicholas Hoult as a student and Jon Kortajarena as a hustler, as if they were models selling product rather than characters, or even actors. (In fact Kortajarena is a male supermodel; the shocker is that Hoult is not, though Hugh Grant’s erstwhile About a Boy co-star is so preening here you’d never guess.) Eventually Ford stops showing off so much, and A Single Man is effective to the precise degree it lets good work by Goode, Moore and especially the reliably excellent Firth unfold without too much of his terribly artistic interference. *Terribly Happy The Coen Brothers’ Blood Simple (1984) is the obvious corollary for this coolly humorous Danish import, though director/co-writer Henrik Ruben Genz’s firmly dampened-down thriller of sorts is also touched by David Lynch’s parochial surrealism and Aki Kaurismäki’s backwater puckishness. Happy isn’t quite the word for handsome, seemingly upstanding cop Jakob (Robert Hansen), reassigned from the big city of Copenhagen to a tiny village in South Jutland. There he slowly learns that the insular and self-sufficient locals are accustomed to fixing problems on their own and that cows, trucks, and other troubles have a way of conveniently disappearing into the bog. When buxom blonde Ingerlise (Lene Maria Christensen) whispers to him that her husband Jørgen (Kim Bodnia) beats her, Jakob begins to find his moral ground slipping away from him — while his own dark secrets turn out to be not so secret after all. More of a winkingly paranoid, black-hearted comedy about the quicksand nature of provincial community and small-town complicity than a genuine murder mystery, Terribly Happy wears its inspirations on its sleeve, but that doesn’t stop this attractively-shot production from amusing from start to finish, never tarrying too long to make a point that it gets mired in the bog that swallows all else. Up in the Air After all the soldiers’ stories and the cannibalism canards of late, Up in the Air‘s focus on a corporate ax-man — an everyday everyman sniper in full-throttle downsizing mode — is more than timely; it’s downright eerie. But George Clooney does his best to inject likeable, if not quite soulful, humanity into Ryan Bingham, an all-pro mileage collector who prides himself in laying off employees en masse with as few tears, tantrums, and murder-suicide rages as possible. This terminator’s smooth ride from airport terminal to terminal is interrupted not only by a possible soul mate, fellow smoothie and corporate traveler Alex (Vera Farmiga), but a young tech-savvy upstart, Natalie (Anna Kendrick), who threatens to take the process to new reductionist lows (layoff via Web cam) and downsize Ryan along the way. With Up in the Air, director Jason Reitman, who oversaw Thank You for Smoking (2005) as well as Juno (2007), is threatening to become the bard of office parks, Casual Fridays, khaki-clad happy hours, and fly-over zones. But Up in the Air is no Death of a Salesman, and despite some memorable moments that capture the pain of downsizing and the flatness of real life, instances of snappily screwball dialogue, and some more than solid performances by all (and in particular, Kendrick), he never manages to quite sell us on the existence of Ryan’s soul. Valentine’s Day Genre moviemaking loves it a gimmick — and nothing gets more greeting-card gimmicky or sell-by-date corny than the technique of linking holidays and those mandatory date nights out. You’re shocked that nobody thought of this chick flick notion sooner. Valentine’s Day is no My Bloody Valentine (1981, 2009) — it aspires to an older, more yupscale lady’s choice-crowd than the screaming teens that are ordinarily sought out by horror flicks. And its A-list-studded cast — including Oscar winners Julia Roberts, Jamie Foxx, and Kathy Bates as well as seemingly half of That ’70s Show‘s players — is a cut above TV tween starlets’ coming-out slasher slumber parties. It partly succeeds: bringing Valentine’s haters into the game as well as lovers is a smart ploy (although who believes that the chic-cheekbones-and-fulsome-lips crew of Jessica Biel and Jennifer Garner would be dateless on V-Day?), and the first half is obviously structured around the punchlines that punctuate each scene — a winning if contrived device. Juggling multiple storylines with such a whopping cast lends an It’s a Mad Mad Mad Mad World (1963) quality to the Jessica- and Taylor-heavy shenanigans. And some tales get a wee bit more weight than others (the charisma-laden scenes with Bradley Cooper and Roberts cry out for added screentime), creating a strangely lopsided effect that adds unwanted tedium to an affair that should be as here-today-gone-tomorrow as a Whitman’s Sampler. *The White Ribbon In Michael Haneke’s The White Ribbon, his first German-language film in ten years, violence descends on a small northern German village mired in an atmosphere of feudalism and protestant repression. When, over the course of a year, a spate of unaccountable tragedies strikes almost every prominent figure as well as a powerless family of tenant farmers, the village becomes a crucible for aspersion and unease. Meanwhile, a gang of preternaturally calm village children, led by the eerily intense daughter of the authoritarian pastor, keep appearing coincidentally near the sites of the mysterious crimes, lending this Teutonic morality play an unsettling Children of the Corn undertone. Only the schoolteacher, perhaps by virtue of his outsider status, seems capable of discerning the truth, but his low rank on the social pecking order prevent his suspicions from being made public. A protracted examination on the nature of evil — and the troubling moral absolutism from which it stems. (2:24) Clay, Shattuck. (Nicole Gluckstern)

The Wolfman Remember 2000’s Hollow Man, an update of 1933’s The Invisible Man so over-the-top that it could only have been brought to you by a post-Starship Troopers (1997) Paul Verhoeven? Fear not, Lon Chaney, Jr. fanclub members — The Wolfman sticks fairly true to its 1941 predecessor, setting its tale of a reluctant lycanthrope in Victorian England, where there are plenty of gypsies, foggy moors, silver bullets, angry villagers, and the like. Benicia Del Toro plays Lawrence Talbot, who’s given an American childhood backstory to explain his out-of-place stateside accent (and a Mediterranean-looking mother to make up for the fact that he’s supposed to be the son of Anthony Hopkins). Soon after returning to his estranged father’s crumbling manor, Lawrence is chomped by a you-know-what. Next full moon, Lawrence realizes what he’s become; murderous rampages and much angst ensue. (He’s kind of like the Incredible Hulk, except much hairier). Director Joe Johnston (a tech whiz who worked on the original Star Wars movies, and helmed 2001’s Jurassic Park III), doesn’t offer much innovation on the werewolf legend (or any scares, for that matter). But the effects, including transformation scenes and claw-tastic gore, are predictably top-notch. (2:05) 1000 Van Ness, SF Center, Sundance Kabuki. (Eddy)

REP PICKS

*The Hellcats The problem with most old biker movies is that there’s waaaaay too much aimless hog riding occasionally interrupted by repetitious fist and/or chain-fighting. This obscure 1967 entry, however, gets its priorities right: the characters are pretty seldom on the road, for that would leach precious time away from the hilarious quasi-hipster dialogue, fascinating personalities (with names like "Six Pack," "Heinie" and "Zombie"), and complex intrigue. Ross Hagen and Dee Duffy play the military-officer brother and fianceé, respectively, of a freshly assassinated police detective. To investigate they go undercover as the new biker couple in town, infiltrating the Hellcats’ clubhouse where booze, acid ("You ran into a bad cube, man!"), drug-running, and chick-swapping are the usual entertainment. These are hippie bikers, though they talk like Hollywood "beatniks" circa 1959 — which is to say, like no one who ever actually lived. They call each other Mamma, Daddy, and Baby a lot, and it’s presumably this familial spirit that leads both motorcycle gang and undercover pigs to finally join forces in defeating the real bad guys, some big-league mobster types. You know this movie is going to rock from the start, as blobular psychedelic paintings background opening credits to the sound of the lamest Farfisa organ-driven theme song ever. This was the first narrative feature by director Robert F. Slatzer, who for years claimed he was married to Marilyn Monroe for three days in 1952 (and subsequently milked two books out of that tall tale). His second (and last) was the even more ludicrous 1970 Bigfoot, in which bikers rescue pretty girls kidnapped and kept chained in a cave by horny sasquatches. A past Mystery Science Theater fave that requires no snarky commentary to entertain, Hellcats is presented as a double-feature with a better-known wanton-youth nugget, 1964’s Kitten With a Whip, starring a very naughty Ann-Margret. Who cares about SF’s (black and brown) prisoners? Part 2

Eileen Hirst of the San Francisco County Sheriff’s Office just sent me statistics that prove that the majority of folks sitting in our county jails are black men awaiting trial — statistics that underscore the extent to which the “let’s not rebuild the prison” debate really is racially tinged:

“On any given day, we have about 2000 to 2100 people in custody,” Hirst said, noting that the two jails at the center of the debate only house male prisoners.

The biggest group in custody, Hirst said, are African American (58 percent). Next come Caucasians (18 percent), Latinos/Hispanics (15 percent), Asians (4 percent) and others (4 percent).

The overwhelming majority are male (87 percent).

And the vast majority (80 percent) are simply awaiting trial.
”Only 20 percent of the jail population is sentenced,” Hirst said.

So, does this mean that the nine supervisors who voted this week for a $412 million seismic safety bond that won’t upgrade these jails are racist?

No, but it does suggest that they believe that voters won’t support a bond that uses money to help build safe facilities to house black men in custody. Instead, the $412 million bond they voted to place on the June ballot will be used to build a new police command center, and retrofit firehouses and secure their water supply.

“No one is saying that we’re not going to rebuild the jails, but they are going to do the project in phases, and this bond represents the first phase,” Hirst said.

She noted that two previous attempts to pass bonds to rebuild prisons failed to get the required two-thirds of voter approval.

(In 1992, 57 percent of voters approved a $158  million general obligation bond, ten percent short of the needed 67 percent. Two years later, in 1994, only 54 percent of voters approved a similar bond, only know the same project’s costs had expanded to $195 million.)

‘And at that point we were under a federal court order to rebuild the jails,” Hirst said. She recalled how hot water had to be pumped in from a flatbed truck parked on the front lawn in front of those facilities that lay just two football fields away from the San Andreas fault, and that they have since been rebuilt.

Hirst said community groups went out with huge photos of those poor conditions, but the public still didn’t vote to support the bond, and the jails eventually got  rebuilt through a “certificate of participation” financing mechanism that Monique Moyer (who was then mayor Willie Brown’s director of public finance) came up with.

“So. I don’t think we are not going to rebuild,” Hirst said. “But we do operate in a landscape of competing priorities.”

Why foot patrols make sense

I had lunch with the chief of police yesterday. George Gascon is far sharper than the past few people to occupy that office, and seems to understand the need to reach out to the news media and to people who don’t agree with him. He’s actually a pretty skilled politician — which is a bit scary to folks who think he’s going in the wrong direction

And on a lot of things, I think he is.

We talked a lot about the sit-lie law that he’s been pushing, which I wrote about this week. Gascon insisted that he doesn’t want to use the law as a way to sweep homeless people off the streets; in fact, he told me, he doesn’t want to put anyone in jail, not at first, anyway. He’s rather use the law as a tool to get the young bullies and thugs (who are, by the way, a real problem on Haight St.) into the criminal justice system, where they might get access to services that could help them change their behavior.

I don’t see it working. What I see is either (a) the troublemakers will simply stand up when the cops arrive and walk to another part of the street or (b) some will get arrested, released, arrested, released, etc. — rejecting or ignoring all possible services — then ultimately, on the fourth or fifth offense, wind up in jail.

And all of of those arrests and court hearings are expensive.

In fact, Gascon and I agreed on two central points: (1) Putting two cops on foot patrol on Haight Street, between Buena Vista Park and Golden Gate Park, 13 hours a day, would end the problem pretty quickly and (2) the cost of doing that, which he put at close to $1 million a year (a bit high, I think), is probably lower than the cost of arresting, prosecuting, defending and incarcerating the Haight bullies.

This is something to look at.

Sup. Ross Mirkarimi wants to hold a hearing on the issue, and I think he ought to ask the controller or the budget analyst to examiner the real costs: What’s the price tag of foot patrols in the Haight? What’s the cost to the district attorney, the public defender, the courts and the Sheriff’s Office of implementing a sit-lie law? And could the foot patrols be a cheaper way of solving this problem?

And whatever Gascon says about his intent, once you pass a law like this — a law making it a crime to sit or lie on the sidewalk — it’s there, on the books, ripe for abuse. Gascon won’t be the chief forever. And he has to answer to the mayor, who may want to use the law a little differently.

So before we go that route, why not try foot patrols? According to Gascon, the department can’t afford it; with a huge budget deficit and cuts on the way for every agency, spending a million bucks on Haight Street doesn’t make sense. But the supervisors should look at this citywide; spending $1 million on preventing crime with foot patrols (if that’s what it would really cost) may be a lot more cost-effective than spending $2 million arresting, prosecuting, defending, sentencing and incarcerating people.

It’s at least worth a try.

Not your typical board meeting drama

Yesterday’s Board of Supervisors meeting was thrown into disorder when a woman began shrieking, “Get away from me!” She was yelling at Sheriff Deputy Thompson as he forcibly led her to the door of the Board Chambers, gripping her by the arm.

An angry showdown manifested in the corridor just outside the doors when a group began shouting chants in protest of the officer’s move.

The woman, Maria Cristina Gutierrez, is a principal at Mission-based preschool Companeros del Barrio, she later told reporters. She and other preschool staffers had attended the meeting with a group of kids, ages 3 to 5, to deliver handmade cardboard messages to Sup. David Campos opposing the Muni layoffs, since some of the kids’ parents will be affected. She told reporters that once she realized they were short on time and wouldn’t be able to stay for the whole public comment session, she was scrambling to get the signs completed and hand-delivered to the supervisor.

Exactly what took place next will come under close scrutiny in the course of an investigation, but it’s clear is that the situation escalated to the point where the entire meeting was disrupted, Gutierrez wound up with a mark where her arm was twisted, and the kids were frightened. This isn’t the first time this sort of thing has happened at a Supervisors meeting — last July, Fog City Journal blogger Luke Thomas was also forcibly ejected from a meeting by Deputy Thompson after being told he was getting too close while photographing an event.

According to a sheriff’s incident report containing a narrative from Sheriff Deputy Saenz, who was also on duty, the trouble started because Gutierrez, her adult son, and two of the kids were blocking the center aisle when they were working on the signs. They did not respond to requests made in English and Spanish to return to their seats, the report notes.

The SF Weekly still gets it wrong

I found it somewhat amusing that the SF Weekly’s writers, Benjamin Wachs and Joe Eskenazi, were really worried about whether we would be “professional” in responding to an inaccurate story about city finance:

We appreciate that the Guardian was kind enough to send us its letter prior to running its article, likely this week. Communications from the paper’s reporter have been thoughtful and professional — so we hold out hope that this may be an article that could do more than simply obscure San Francisco’s gaping weaknesses with analytical smokescreens. On the other hand, it may yet be a hit piece written for the benefit of the city political bodies the Guardian openly aligns itself with and shills for — and who are responsible for some of the misgovernment highlighted in our story

And then go on to respond to us with a piece that’s mostly snark – snark being the refuge of reporters who don’t really have facts to lean on.

I’m going on KQED’s Forum show Friday morning to debate the Weekly guys about this, which will be fun, but in the meantime I have to set something straight.

From the Weekly story:

The Guardian gets to break its own rules and compare San Francisco’s budget to L.A.’s and Chicago’s by “add[ing] to the L.A. and Chicago city budgets a percentage of the L.A. County and Cook County spending equal to each city’s percentage of the county population.”

This would make perfect sense — if it didn’t make no goddamn sense. You can’t just determine overlapping city and county budgets via long division; cities are cities and counties are counties because they have differing, separate services. L.A. City and County each have their own Departments of Public Works, Building Inspection Departments, road crews, parks departments, you name it. Cities pay for their own services because they usually don’t use the counties’. Simply adding a lump sum of county costs on to city costs makes about as much sense as multiplying the city numbers by Planck’s Constant.

Whoa – Planck’s Constant. Dude – you musta gone to college or something.

The fact is that you not only CAN compare SF to Los Angeles and Chicago by accounting for both city and county spending – you HAVE TO.

A little lesson in public finance here, since that’s one college class the Weekly boys apparently slept through.

Most communities in the U.S. have four basic levels of government – federal, state, county, and city (or township, or town). Some have even more (village etc.) and some have fewer (Connecticut abolished county-level government many years ago). And there are special districts, like BART and AC Transit and school districts and mosquito abatement districts and lots more.

But for this particular argument, we’re looking at state, county and city government. That’s what you get in California.

The counties, as operating arms of the state, provide many, many services – expensive services – to people who live in cities. In Los Angeles, for example, there’s a city police department that handles law enforcement. But after someone’s arrested by the LAPD, the COUNTY district attorney, the COUNTY public defender, and the COUNTY courts system take over. And if the perp is guilty, the COUNTY sheriff takes custody (or else the state does).

Los Angeles COUNTY provides much of the welfare money for poor residents of Los Angeles CITY. Los Angeles COUNTY runs the system that counts the ballots for Los Angeles CITY elections.

You get the point.

So if you want to compare spending in the city of Los Angeles to spending in the CITY AND COUNTY of San Francisco, you have to either (a) eliminate all of the functions that count as county services in San Francisco or (b) much simpler, estimate what percentage of the L.A. county budget goes to services in L.A. city.

We took a rational approach – take the population of L.A. city and the population of L.A. County, and apportion to L.A. city a percentage of the county budget equivalent to the proportion of county residents who live in the city. That’s probably a low estimate of county spending in L.A. city, since more of the crime and welfare needs of the county are situated in that one city than in any other part of the vast county.

But whatever, we’ll take the lowball number.

Not magic, not physics, not chemistry, just basic common-sense and a basic understanding of how finance works in American cities.

Is this perfect? No. What you really need to do is analyze exactly how much government money – state, federal, city, county, special district etc. – is spent in every city you want to compare. That’s a bigger task than either the Weekly or the Guardian has taken on so far.

And I admit – we may be wrong by a few percent one way or the other. But we aren’t the ones trying to claim that the city spends vastly more money than anyone else who compares to us.

Oh, and as for this:

On the other hand, it may yet be a hit piece written for the benefit of the city political bodies the Guardian openly aligns itself with and shills for — and who are responsible for some of the misgovernment highlighted in our story

Let me point out that most of the problems the Weekly points to are management issues that properly belong in the office of the Mayor of San Francisco.

And I don’t know in what possible universe – other than a Weekly hallucination – anyone could argue that Gavin Newsom is someone the Guardian is, or has ever been, aligned with.

The truth about San Francisco’s budget

“San Francisco,” SF Weekly recently proclaimed, “is arguably the worst-run big city in America.” That’s a hell of a claim — the levels of corruption and mismanagement in urban America are legendary. But the Weekly’s Benjamin Wachs and Joe Eskenazi set out to prove their case — with a series of mostly anecdotal points that looked at the usual targets: Nonprofits. Unions. And one senior Newsom administration staffer who pretty much everyone agrees was a horrible manager.

We were tempted to just let it go. Sure, there’s plenty of incompetence and waste in the Newsom administration. There’s a need for more accountability in some of the nonprofits that get city money. The police union got too big a raise in 2007.

That pattern also exists in a lot of other big cities. You wanna make a big headline by claiming SF is the very worst? Whatever.
But the heart of the Weekly’s factual analysis was a chart that purports to show that San Francisco spends vastly more per capita than other “comparable” cities. That’s a claim we hear all the time, one that the more conservative political forces constantly use to argue against higher taxes (and in favor of big spending cuts).

So it’s worth exploring a little further. Because when you look at all the facts, the Weekly analysis is just wrong.

Comparing cities is a complex task — urban areas in America are governed in very different ways. You can’t, for example, compare San Francisco to any other city in California because San Francisco is the only combined city and county. Get arrested in Berkeley, and the Alameda County sheriff locks you up, the Alameda County district attorney prosecutes you, the Alameda County public defender takes your case, and the Alameda County courts adjudicate it. And if you win, you ride home on AC Transit — a separate system that isn’t in the budget of either the city or the county.

In San Francisco, all those things are in the same city budget.

But Wachs and Eskenazi decided to get beyond that. “Any time someone tries to point out that San Francisco has serious systemic problems, the response (from the Mayor’s Office, from city bureaucrats, and sometimes even from city activists) is that ‘San Francisco is both a city and a county,’ as if that explained everything,” Wachs told us in an e-mail. “So the comparison was already being made as part of the city’s defense: San Francisco is a city-county, and what appear to be systemic problems are actually just features of being a city-county.

“We proved that isn’t the case: San Francisco’s per capita spending is significantly out of line even when compared to other large city-counties.”
Actually, it’s more than just the city-county distinction. The large cities-counties SF Weekly chose are so dramatically different in the services they do — and don’t — provide that the comparison comes close to being meaningless. Ken Bruce, a partner in the Harvey Rose Accountancy Firm, which serves as San Francisco’s budget analyst and does similar work in other cities, is no fan of wasteful spending. But he told us he wasn’t impressed with the Weekly chart: “I have yet to see a rigorous analysis done comparing San Francisco to other cities,” he said.

And the way the Weekly added up the numbers was, at best, misleading.

For starters, San Francisco runs (and includes in its city budget) an airport, port, public transit system, county hospital, and skilled nursing facility (Laguna Honda), for a total of more than $2 billion. None of the comparison cities do all those things. Or rather, some do those same things — but they aren’t in the local budget.

In Philadelphia, for example, the public transit system is a regional agency. Philly chips in $63 million from its general fund to help the Southeast Pennsylvania Transit Authority (SEPTA). SF pays almost three times that much to run its own Muni, because the overhead costs are included in the local budget. Philly taxpayers spend much more than $63 million on SEPTA — it just comes out of a different budget and funding stream, so it isn’t in the figures the Weekly used. Denver’s transit system is regional too, and thus not in the city-county budget.

In Indianapolis, the city transit system, Indygo, is far less complicated than ours. Jenny Brown, a spokesperson for Indygo, told us she was amazed her city was being compared to San Francisco: “Our transit system is not in the same league as yours,” she said.

Philadelphia also does not pay for a county hospital or include its port or airport in its budget. Neither does Denver.

There’s also a difference in most municipalities between the general fund (locally allocated spending) and the total budget, which includes federal and state money, self-sustaining departments, etc. In Philadelphia that’s a big distinction — more than $3 billion a year — but the Weekly compared Philly’s general fund to SF’s total budget (something Wachs admitted to us was his mistake).

So we took this a step further. First, in Chart A, we compare apples to apples — general funds to general funds. It turns out SF and Philly are relatively close in per capita spending. Then we adjusted the budgets to account for the fact that SF includes in its budget a lot of services other cities and counties budget somewhere else. That makes all the comparison cities a lot closer.

But can you really compare San Francisco — with its diverse and complex population and urban problems — to Indianapolis or Nashville? Even Denver? If even the folks in Indianapolis think that’s kind of bogus, we figured we could do better. So we set out to find some cities that make a more fair comparison. We included Philadelphia, but added Los Angeles and Chicago (New York, by the way, is so big, so complex, and has so many counties, boroughs, and budget items, that it’s not fair to compare that city to any other — even though is would help our case). To account for the city-county issue, we added to the L.A. and Chicago city budgets a percentage of the L.A. County and Cook County, Ill. spending equal to each city’s percentage of the county population. (Not a perfect yardstick, but pretty close).

As Chart C shows, all four big cities are within about 30 percent of each other in terms of per capita spending.

But there’s another big factor — cost of living. The vast majority of the budgets of these cities goes to employee pay and benefits — and it stands to reason that a city with a higher cost of living would have to pay its employees more. And San Francisco has by far the highest cost of living (according to the latest figures from the Council for Community and Economic Research’s ACCRA Cost of Living Index) of all the cities in this chart.

So we adjusted per capita spending by the cost of living index (SF = 169, L.A. 145.4; Philadelphia, 124.1; and Chicago, 110.8) and discovered that in fact all four big cities spend roughly the same per capita — although San Francisco spends the least.

So is San Francisco a service-rich city (like L.A., Philadelphia, and Chicago)? Absolutely. Is SF’s spending far out of whack with what other similar municipalities spend? No, not at all. All things considered, it’s a little low.

PS: The Weekly spent much of its article attacking the lack of accountability in the city’s $500 million’ worth of nonprofit spending. That’s a huge issue, but oddly, the Weekly didn’t quote a single person who supports the system San Francisco uses to distribute services through nonprofits.

We’ve been critical of many individual nonprofits, and some are over-funded, wasteful, and of dubious value. But overall, as labor activist Robert Haaland told us: “The fact that an individual nonprofit isn’t performing up to standard doesn’t mean that the services aren’t needed.”

And there are many who say the San Francisco model is, in fact, a national standard. Margaret Brodkin, former director of the Mayor’s Office for Children, Youth, and Families, helped develop the current system of nonprofit accountability in that office. She has been invited to speak all over the country about the standards and data system they developed. “Others have replicated the data system we had in place. It’s held up as a national model, the data system as well as the standards,” she explained.

So it’s not so simple — and to use a few anecdotes and some inaccurate and misleading figures to call San Francisco the worst managed city in the nation is, well, a bit of a stretch. To say the least.

Is SF spending too much money?

When the SF Weekly ran its cover story a couple of weeks ago calling San Francisco “the worst-run big city in the U.S.” my first thought was to ignore it. That kind of claim is meaningless; it’s just a flashy headline, and the story didn’t back it up with much more than a few examples of bad management of the sort that occur in cities all over.

So what makes San Francisco “the worst?” Well, part of it, said the Weekly, is the fact that SF spends more money per capita than any comparable city and county. In fact, according to a chart the Weekly included in its story, SF spends more than twice as much per capita as Philadelphia (which is actually a comparable city, with big-city problems and a fairly rich service mix) and spends more than four times as much as Indianapolis (which isn’t comparable for a lot of reasons).

But the minute I started paying attention to that chart, I knew there was something really wrong. Melanie Ruiz and I spent some time checking it out, and we found that the “comparisons” are somewhere between misleading and totally bogus.

Here’s what we found.

What’s important here is that it’s really hard to compare any two cities in America on this level. Cities are organized in so many different ways, and their budgets are set up so differently, that any direct comparison is going to look like apples to oranges.

For example, Philadelphia and San Francisco both have extensive, costly public transportation systems. Taxpayers in both cities underwrite those systems. But in Philly, the system, known as the Southeast Pennsylvania Transit Authority, is a distinct agency (like BART is out here); the city and county of Philadelphia contributes $63 million a year to its operations, but the major overhead costs are outside of the city budget.

There’s an airport in Philly, too. It’s expensive to run, just as SFO is expensive to run. It mostly pays for itself through landing fees, just as SFO does. In San Francisco, the cost of the airport (which takes no taxpayer money) is included in the city budget; in Philly, it’s not.

People in Philly who get sick and have no insurance don’t die in the streets – but that city and county doesn’t fund a public hospital the way SF does.

In fact, San Francisco’s budget includes just about everything that any city offers. It’s not that this city provides services nobody else does (well, we do, but that doesn’t explain the budget differences entirely). It’s that other cities and counties don’t include those services in their budgets.

Now, the folks at the Weekly, who criticized our story before it was even out, argue that

Yes, our city pays for things others don’t — but, then, other cities have to maintain aging infrastructure weakened by extreme heat and cold. Other cities have to keep up municipal vehicles ravaged by salt. Other cities have to shovel snow. Other cities have miles and miles more pothole-filled streets to look after. Other cities’ Sheriff’s Departments have many more responsibilities than San Francisco’s. Other cities have police forces larger than several European nations’ standing armies and security costs that dwarf this city’s.

All of which is true – and makes the point that you can’t do exact comparisons without doing a whole lot more work than the Weekly did on its chart.

But most of those items are million-dollar items – shoveling snow costs Denver, for example, millions a year – but not hundreds of millions or billions. Same for filling potholes. (Most cities don’t have Sheriff’s Departments, by the way – that’s a county function – and the county sheriffs who do more work are policing unincorporated areas. And the only city with that massive police force is New York, which is so unusual that it’s hard to compare it to any other American city.)

But the bottom line is, those are (comparatively) small-ticket items. The items that make a city budget seem huge are the departments and programs that run in the multiple hundreds of millions of dollars, and those tend to be things like public hospitals, transit systems, and airports. In SF, they account for more than $2 billion a year – and because of the way this city is set up, all of that goes in the same $6.5 billion budget.

We tried several ways to make a better comparison, which you can see here (pdf)

We compared general funds to general funds (something the Weekly got wrong). We deflated the SF budget by taking out those big-ticket items that other cities don’t include in their budgets. We tried to find cities more comparable to SF – big cities with big-city problems and services – and we tried to adjust those budgets to account for the fact that some of those cities get extensive services that are paid out of separate county budgets.

And we did something else: We took into account the cost of living. The vast majority of what the city budget (here and elsewhere) goes for is salaries of city workers. It costs a lot more to live here, so we pay our workers better. There are plenty of academic studies that look at comparable costs of living in cities; we used a generally accepted one.

And when we were done with all of this we came to the conclusion that SF doesn’t spend more than comparable cities; it’s really about the same.

Now that’s probably unfair to San Francisco (and Los Angeles). We’re in California, where the state doesn’t spend as much per capita on programs that aid cities as other states do. Yes, the state has a budget of more than $100 million dollars, but 40 percent of that goes for education – and in many other states, local property taxes pay for much of the cost of public schools. In California, thanks to Prop. 13, local property taxes are inadequate to provide decent public schools, so the state has taken up the burden.

When you take that factor out of the state budget, and compare California to other states, the per-capita spending is pretty low.

Our comparisons aren’t perfect. There are other cities to look at, other line items to examine, other methods of comparing that are also valid. The folks who read this blog (and the folks at the Weekly) will no doubt argue with our methods, and I bet somewhere in there we made some mistakes. But overall, I think our approach is more accurate.

People who live in cities typically pay taxes to several levels of government – the feds, the state, special districts (like BART), school districts (except in California), counties and the cities themselves. I would argue that San Franciscans probably pay less per capita than the residents of many other cities (certainly less as a percentage of their income). We just pay it all into one big pot.

That’s why the SF Weekly chart was so misleading. And why this kind of argument shouldn’t be used to say that San Francisco spends too much money on government.

I’m not going to argue that local government is perfect, or that it’s free or corruption and waste. There’s a lot of waste in San Francisco (does the mayor really need five press aides?) and plenty of inefficient spending.

But overall, it’s not a whole lot worse than other cities. That’s my conclusion.

Cazadero

While it’s true that several skinny-dipping holes used by local residents are located near the Russian River town of Cazadero, they are surrounded by private property. And their owners don’t like trespassers, so if they spot one, they are usually quick to call deputies.

Legal status:

The area around the holes is private property. But what about the water? It’s a murky question. “Many property owners claim the water to the middle of the river as their property,” says Sonoma County Sheriff’s Deputy Gregg Paul. Lawyers who have researched these claims say that “if you can kayak or paddle to a swimming hole, you can use it, but not the riverbank,” adds Paul. “But if you can’t paddle to it, it’s private property.” When called to the scene, deputies usually try to avoid the controversy by urging visitors to leave. See Lower Wohler Bridge for policy. If you have any questions about legal issues, we suggest you contact local authorities.

How to find it:

From San Francisco, take Highway 101 north, past Santa Rosa, to River Road. Follow River Road and Highway 116 west through Guerneville to the cutoff for Cazadero, which is called Austin Creek Road. Turn left on Cazadero. Hole one: In town, take Fort Ross Road west past Neistrath Road to Bohan Dillon Road. (If you get to Meyers Grade Road, you’ve gone three miles too far.) Turn right on Bohan Dillon, a dirt road that crosses a bridge. Park in the meadow just before the bridge. Take the little trail that starts there through the trees and bushes to the riverbank. Hole two: Look for cars pulled over off Kings Ridge Road, which heads north from Cazadero.

The beach:

Little riverside swimming holes, usually ringed by private land.

The crowd:

Use varies, but is often limited to just a few people, even on the hottest days. More often, such places are deserted.

Problems:

You’ll probably be visited or cited by a deputy if the owner of the property or a family member, friend, or passerby complains; trash; noise; needs better directions.

Lower Wohler Beach

Despite obstacles, a few die-hard nudists continue to defy Sonoma’s stringent anti-nudity law.  Even more amazing:  an end to most parking from June-September hasn’t halted naturists from biking or walking to Lower Wohler Beach. But use has been reduced to a few dozen people on the hottest days.  Visits by deputies only take place when complaints are received, according to Diana Nolan, of the Guerneville substation of the Sonoma Sheriff’s Department.  “We don’t have a patrol (for anti-nudity),” she says.  Visitors walk upstream along a trail lined by trees and other vegetation to a small clearing used mainly by gays, plus a few others.  “I see hikers, bikes, couples, and mixed singles,” says Tom, a regular visitor.

How to find it:

From San Francisco, take Highway 101 north past Santa Rosa to River Road, then go west for 10 minutes to Wohler Road. Turn right onto Wohler and drive 1.4 miles to the bridge, continue across it, and, from October through mid-May, look for $6 per vehicle parking at 9765 Wohler Road.  The site has a parking lot, chemical toilet, and boat ramp.  Parking’s almost impossible to find on Wohler or River the rest of the year, but you can still walk or bicycle to Wohler. On the south side of the bridge, look for a steel fence and go through a green gate with a large Keep Clear sign. Walk or ride past the water facility. An all-weather gravel trail to the nude beach and beyond starts there. The Water Agency doesn’t hassle bikers or hikers on the path. The walk from the gate to the nude beach is easy and takes maybe 15-20 minutes, with the path sloping down through a redwood forest next to the river. Where the trees end, you’ll see a fork in the road. Follow the right fork to the meadow being used by nudists. A path there also leads down to a little beach. If you come to a water collection pumping area, it means you’ve gone too far on the trail and should turn around, retrace your steps, and look for the clearing.

The beach:

“There is a good beach and nice private areas for sunning,” reported a Guardian reader. “The trails are better and the meadow is still getting use.  If you bike in, it takes about five minutes from the last No Parking sign.” Wohler’s eighth-to-quarter-mile-long ribbon of flat, soft sand and river gravel is fun for sunbathing. Although boats, floats, and canoes are frequently passing the site, a few visitors occasionally wade in the water or set up a net and play naked volleyball in the clearing. However, the riverbank is eroding, so some nudists are now visiting Upper Wohler Bridge, another beach that is just upstream.

The crowd:

Many visitors are nude gay males. Expect several dozen users on the hottest weekend days, but usually just a few visitors.

Problems:

Eroding beach; area subject to raids based on complaints; proximity of canoeists and other water craft users; path may be muddy following rainfall; garbage; no summer vehicle parking available; long walk from the parking area; possible poison oak if you don’t stay on the trail and within clearing; complaints of gay cruising in meadow area.

Despite the erection of anti-nudity warning signs at longtime nudie fan favorite Bonny Doon Beach, north of Santa Cruz, officials have told us they have no immediate plans to issue citations at the north end of the site, which has traditionally been occupied by naturists.

In fact, in June, Pam, of San Mateo, even found a nudist “wandering around,” as she calls it, the main public, south side of the beach, which is used by suited visitors. A 15-foot long rock on the sand, along with a sloping cliff with rocks that jut out, separate the two sides of the cove that form Bonny Doon.

“In the short term, things at Bonny Doon are destined to continue the way they are,” says Kirk Lingenfelter, sector superintendent for Bonny Doon and nearby state beaches.

“Ultimately it would be nice to see some level of improvement, maybe trail work or stair work,” adds Lingenfelter. “But before we’d even do that, there would need to be a General Plan or an Interim Use Plan, which we don’t have. And we also don’t have any funding for it.”

Lingenfelter says he likes Bonny Doon just the way it is. “It’s one of our pocket beaches,” he explains. “They can really give you the feeling of rugged, untouched majesty. I like standing on those beaches. You can sometimes forget that there’s a highway in the distance. It’s a very important feeling to maintain.”

As for nudity, Lingenfelter says his rangers, who periodically patrol the beach, haven’t issued a single warning or citation for nudity since the state approved the acquisition of the beach in 2006. “We’ll respond to complaints we receive,” he explains, “but I can’t recall (receiving) a single complaint.”

Asked about reports to a nudist group by two naturists, in separate incidents in the summer of 2009, that they were told to suit up by an unidentified law enforcer, Lingenfelter denied his rangers were involved. He admitted that “there is some overlap” of law enforcement at the beach by deputies of the Santa Cruz Sheriff’s Department, but a spokesperson for the Sheriff’s Department says they did not take such action.

Bonny Doon usually gets high marks from beachgoers. “It was perfectly secluded,” says Pam who plans to return. “Folks kept to themselves.” John, of San Leandro, who dropped by in February, calls it “gorgeous.” Dusty, of Santa Cruz, rates it as “tranquil.” He also likes its “stunning views.”

“I love this beach,” said visitor Caitlin, of Campbell, on a message board.

But last year five beachgoers, including a friend of Caitlin’s, encountered overly aggressive men at Bonny Doon.  Says Jeff P., of Palo Alto, on Yelp, who was approached for sex by one: “These pervs sap the credibility from nudists.” Elizabeth, of San Jose, reports being asked by a middle-aged male nudist if “I needed to get tanning lotion put on. I gave them the get away from me look and things were cool after that.” 

“I love nude beaches,” said another poster, Jill, of Santa Cruz, after a visit. “So far, Bonny Doon is the only one at which I’ve actually felt uncomfortable, even with my boyfriend at my side the entire time … Even after we … left the nude part of the beach, one of the men actually got up and followed us. How creepy can you get?”

Julie, of the East Bay, had a similar experience. “For women, I would not recommend going solo if for no other reason than to be left alone,” she said. “I’ve had a few brave ‘johns’ that like to walk up (naked) and introduce themselves even when I’m there with my boyfriend.”

And in a more humorous vein, summer visitor Katie, of Redwood City, complains about the looks of the guys on the sand: “Why don’t some hot dudes come here and sun-bathe naked? That might make it a 5 star beach.”

The clothing-optional section usually attracts more women and couples than most nude beaches. “Minuses” include occasional vehicle burglaries and gawkers on the bluffs or in the bushes.

Legal status:

The beach was frequently used by nudists in the 1960s, following the formation of the so-called Experimental Beach 1958 (XB-58), popularized by Sol Stern, Stan Stohler, and Ed Lange, to bring nudist club members together on the sand and develop the concept of a nude public beach. Formerly privately owned but with public access available under state law, Bonny Doon Beach was sold in 2001. Today, the area east of the highway is owned by the Bureau of Land Management, while the state parks system has, since 2006, controlled the beach, which may eventually become Bonny Doon State Beach. 

How to find it:

From San Francisco, go south on Highway 1 to the Bonny Doon parking lot at milepost 27.6 on the west side of the road, 2.4 miles north of Red, White, and Blue Beach, and some 11 miles north of Santa Cruz. From Santa Cruz, head north on Highway 1 until you see Bonny Doon Road, which veers off sharply to the right just south of Davenport. The beach is just off the intersection. Park in the paved lot to the west of Highway 1; don’t park on Bonny Doon Road or the shoulder of Highway 1. If the lot is full, drive north on Highway 1, park at the next beach lot, and walk back to the first lot. Or take Santa Cruz Metro Transit District bus route 40 to the lot; it leaves the Metro Center three times a day on Saturdays and takes about 20 minutes. To get to the beach, climb the berm next to the railroad tracks adjacent to the Bonny Doon lot, cross the tracks, descend, and take a recently improved, sign-marked trail to the sand. Walk north past most of the beach to the nude cove on the north end. Alternately, Dusty suggests parking as far north as possible, taking the northern entrance, and, with good shoes, following a “rocky and steep” walk down to the sand.

The beach:

Bonny Doon is a sunny patch of sand and surf. You can bring dogs, and if you come before July, you may see whales. “The area just away from the cliff offers good shelter from the wind,” says Pasco. But don’t sit right next to it, as erosion (and falling rocks) is a problem.

The crowd:

Pam spotted a nude man on the clothed end of the beach, plus a photographer, nude model, and several other persons fully or totally unclad on the north side. Later, several older men, two older couples, and a family in their 30s arrived. Bob Wood of San Francisco found several dozen people, almost all nude: young and old, couples and singles, gays and straights, and men and women, though more men than women.

Problems:

Anti-nudity warning signs added; numerous complaints by both male and female visitors in 2011 and 2010 about men making unwanted advances toward them; two warnings for nudity from unidentified law enforcers reported by beachgoers in separate incidents in 2009; fog; wind; gawkers; hazardous waves; loose cliffs; parking lot fills early; auto burglaries; sometimes becomes rocky shelf with no sand in late winter; grains of beach sand are “too big,” according to some visitors.

Mellow times are continuing at one of the Bay Area’s easiest to reach and most enjoyable clothing-optional sites, the clothing-optional north side of Muir Beach.  Also known as Little Beach, it’s separated by the main public beach by a line of large rocks that visitors usually walk over.

Says Lucas Valley’s Michael Velkoff, who switched from Red Rock to become one of more than a dozen regulars at Muir:  “This season, there’s plenty of nice sand.  It’s also a great place for women because people leave you alone here. Nobody’s hitting on you. And high tide only comes a third of the way up the beach.”

Additions over the last year or two include a new bridge over a marshy, lagoon-like area near the parking lot, plus about a half dozen Port-a-Potties.

According to authorities, there have not been any arrests or warnings for nudity since at least July 2010, which followed a controversy the previous year over whether clothing-optional use of the area should be halted.

After several community meetings, it was decided that while beachgoers’ bare buns wouldn’t be banned, a warning sign stressing “respect” for everyone and listing a phone number for complaints would be erected there.

Visits by deputies resulted in only four complaints about skinny-dippers and one citation for improper sexual conduct in 2009. Lt. Cheryl Fisher, commander of the Marin Sheriff’s Department’s substation in Marin City, says that even when people complain, they are usually no longer nude by the time deputies arrive.  “A deputy showed up on a very hot Sunday,” says Velkoff.  “As soon as he left, everybody was naked again.”

The beautiful, curve-shaped cove usually features a diverse crowd, better than average swimming conditions, and very easy access.  Instead of having to trudge down a beach trail, users walk less than five minutes along the shore from the public portion of the beach, called Big Beach, to the nude end. Tip: on warm days, arrive by 11am to find parking in the main lot.

Legal status:

According to the Marin County Assessor-Recorder’s Office,  Little Beach consists of seven privately owned parcels off Cove Lane, in Muir Beach, up to the tidal zone, owned by Sigward Moser; Jason Weisberger and Carolyn Patterson; a trust of Erica and Madeline Groneman; the Elliott Theodore family; Christine and Kenneth High; a trust of Arlene Robertson; and the Nature Conservancy. A community meeting in June 2009 sparked concerns over nudity, sexual acts, such as masturbation, and alleged “intimidation” by nudists — and what, if anything, should be done about the situation. Most of the 50 or so neighbors at the gathering appeared to be in favor of continuing to allow clothing-optional use, but some felt warning signs about perceived illegal activity should go up and others spoke in favor of a ban on nudity. Deputies said regular patrols — but not specific anti-nudity visits — would likely be increased. In 2001, reports of littering, defecation and sexual actions resulted in 20 public nudity citations and dozens of warnings over seven months. And in 1982, deputies made raids on nude sunbathers after receiving complaints about public sex and assaults on women.

How to find it:

From San Francisco, take Highway 1 north to Muir Beach, to milepost 5.7. Turn left on Pacific Way and park in the Muir lot (don’t park on Pacific, even if you see cars there — by the end of the day, they’ll probably all be ticketed). Or park on the long street off Highway 1 across from Pacific and about 100 yards north. From the Muir lot, follow a path and boardwalk to the sand, then walk north to a pile of rocks between the cliffs and the sea. You’ll need good hiking or walking shoes to cross; in very low tide, try to cross closer to the water. The nude area starts north of it.

The beach:

A small, lovely semicircular cove with, in most years, excellent sand for suntanning, reading, and picnicking.  “You can easily swim there,” says Velkoff.  “There usually aren’t any big waves.  But it can also get windy there.”

The crowd:

On a weekday in June this year, about 20 people were on the sand. But expect more than 100 visitors on warmer summer days. Usually, though, summer Sundays produce a crowd of 30-40 persons. Straights, gays, singles, couples, families, seniors, young people, and others share Muir, which has a less social atmosphere than nearby Red Rock. “It’s usually a quiet place,” says Velkoff. “But I still make friends there right away.”

Problems:

Increased scrutiny by local homeowners has resulted in calls to deputies and, in some cases, citations or warnings; complaints about sexual behavior; gawkers; dogs; wind; parking lot jams up early on warm days.

 

Time for serious budget reform

EDITORIAL Rahm Emanuel, President Obama’s chief of staff, likes to say that politicians should never let a crisis go to waste — but that’s what happened in San Francisco last summer, when the mayor and the supervisors approved a budget deal that didn’t involve any real structural reform, didn’t solve any long-term problems, and didn’t even last six months.

Now there’s a new crisis, one that, if anything, is worse. Cutting almost a half-billion dollars from the city budget last year was absolutely brutal. But cutting another half-billion, which is what the controller is now talking about, seems almost inconceivable.

It’s time to quit with the patches, quit with the one-time solutions and fee hikes. And with the mayor missing in action, the supervisors simply have to take the lead here and begin working on major systemic changes that shift the way the city is financed and the way money is spent.

The biggest problem with last summer’s deal was the lack of any serious attempt at bringing in new revenue. Newsom and his advisors all said that tax hikes weren’t looking good in the polls and probably wouldn’t get voter approval, but election results around the Bay suggest otherwise: In city after city, voters approved new taxes to fund essential public services.

And Newsom never gave the revenue side of the equation a fighting chance. He never made any personal effort to lobby the three supervisors he had appointed to the board, who were all reluctant to put emergency tax measures on the ballot. He just let the idea die.

And now the city is paying the price. Everyone with any sense knew last summer that the recession wasn’t going to magically end in time to make this budget work. It was clear that property tax and sales tax revenue would drop even further — and that the only way to avoid brutal midyear cuts was to look for new sources of money. Now the mayor and the board have to slice close to $50 million to keep the red ink at bay, and next year’s deficit is pegged at 10 times that much.

The other glaring problem with the mayor’s budget approach is that it sought to cut only from the front lines. But the highest-paid workers, the folks who make way more than $100,000 a year, the management ranks that have become very well staffed in recent years, were largely untouched. And frankly, there are a lot of people in that category who don’t do much of anything that’s essential to the functioning of the city.

During the dot-com boom, when Willie Brown was mayor and the city was awash in cash, the ranks of the politically appointed managers grew dramatically. Some of those folks are still around. Newsom has added his own. And the structure of management and organization in this city has never been a model of efficiency. So if the mayor wants another round of deep cuts — 20 percent from every department — he should start with a management audit of some of the biggest departments and take a hard look at exactly what all those senior employees do all day — and whether their work might be less important than, say, nurse aides who take care of the sick elderly.

As a simple show of good faith, Newsom shouldn’t replace Nate Ballard, the press secretary, or Kevin Ryan, his criminal justice advisor. There are still four other people in the mayor’s press office, more than any mayor in modern history has ever needed. And the city already has a police chief, police commission, district attorney, and sheriff. Why the mayor needs his own criminal justice office is a mystery to us.

There are other policy issues that need to be examined. The current budget shortfall memo from the city controller notes that some departments are already over budget — the Sheriff’s Office, for example, needs an additional $2.7 million dollars. The public defender and the courts need and additional $4.9 million. Why? Well, one reason is the new police chief’s crackdown on drug sales in the Tenderloin — which is packing the jails. "We’re defiantly looking at a lot of new drug cases," Sheriff Mike Hennessey, who has had to open three new housing units to fit all the prisoners, told us. The crackdown may be good public policy (or not) — but there was never any discussion of how much it would cost. And the mayor and the chief never asked the supervisors to authorize adequate spending for it.

So as a matter of policy, the mayor apparently thinks it’s worth $7 million to arrest drug dealers — but not worth $7 million to keep public-health workers who save lives every day on the job. That’s a policy decision that was made arbitrarily — and that kind of discussion needs to happen on a dozen or more fronts.

The mayor told his department heads Nov. 19 to expect 20 percent cuts — and to prepare for as much as 30 percent. But that’s not going to happen across the board. Unless the police stop arresting people, for example, the sheriff won’t be able to cut 20 percent of his budget without letting prisoners go. The mayor won’t take the political heat for cutting that much from cops and fire. So the burden will fall on public health, Muni, human services, recreation and parks, and other smaller departments. And the level of cuts will render those agencies unable to provide basic services.

So let’s be honest: there is simply no way to close a deficit this large without new taxes. That’s just reality, and anyone who denies it is refusing to face facts. San Francisco can’t survive with basic services — like police, fire, and public health — intact on the amount of money the controller projects the city will collect in the next year.

Newsom will be guilty of destroying the entire social service infrastructure in this city if he refuses to push tax hikes. And he’ll be damaging the local economy if he does it piecemeal.

We’ve been clamoring for years for an overhaul of the city’s tax structure, and now there’s a hurricane-force fiscal storm forcing the issue. If Newsom doesn’t announce plans to hold open, public discussions and draft a new tax policy for the city (and we doubt that will happen) then the supervisors must act, now. Board President David Chiu already had a broad-based committee work on tax reform. Now the board needs to begin drafting comprehensive legislation to change the way the city collects money — with the aim of putting a measure on the ballot as early as possible next year.

The goal should be not only to bring in another $250 million (at least) in new revenue, but to shift the tax burden away from small businesses and the poor and middle class and onto the wealthy. A big first step: get rid of the flat business tax and replace it with a progressive gross receipts tax that charges the biggest companies a higher percentage. Other cities have found numerous other ways to raise money — such parcel taxes, which aren’t quite as fair as ad valorem property taxes, but at least tax property owners, who in general are a wealthier class. A properly written utility users tax would hit big companies that use (and sometimes waste) a lot of power. And of course, a tax on income earned in the city — which would cover commuters who use city services but don’t pay city taxes — is among the most progressive ways to bring in new money.

Meanwhile, let’s remember: fee hikes (for Muni rides, for use of city pools and playing fields etc.) are just hidden taxes — on the poor and middle class.

State law makes it hard to raise taxes; any measure would have to go to the voters. But a major tax-reform overhaul that doesn’t just raise a few taxes on a targeted group but makes the entire system more fair for everyone, ought to be a ballot-box winner — particularly if the mayor is willing to raise money and lead the battle to pass it.


In a Nov. 18 interview with Hank Plante, the KCBS political editor, a testy and impatient Newsom ducked specific questions about how he was going to solve the budget shortfall. After saying that he doesn’t read the newspapers (which, frankly, is either a lie or utterly shameful for a big-city mayor, and leaves him looking as ill-informed as former President Ronald Reagan) he simply said the deficit would be "a lot of work."

That’s an understatement — and Newsom needs to do more than sit in his office and whine about the media. He needs to be out in public, addressing the budget crisis — and he needs to let reporters and residents and business people and the supervisors ask questions and get straight answers.

It’s fine to say that at this point, nobody knows how to solve the problem. It’s not okay to say: trust me, I’ll get back to you on that. This is a citywide crisis, and it’s essential that the public feels involved.

This is the biggest crisis since Gavin Newsom took office. It’s time he started acting like it.

Newsom’s back — and so is the budget axe

The mayor is speaking to the press again. Oh goodie.

First, Hank Plante of KCBS TV gets a sit-down interview that’s stunning in its lack of substance. Newsom gets all pissy and defensive about his trip to Hawaii, says he doesn’t read the newspapers and complains about inaccurate reporting without ever saying what’s inaccurate. (I like Brock’ suggestion at sfist:

Why couldn’t Newsom tell CBS 5’s Hank Plante, “Yeah, I took off to Hawaii. And what, hooker? Somebody hold my earrings.”

Then when Plante finally starts asking about the budget deficit, the mayor totally ducks and won’t say anything except that it’s going to be a lot of work to resolve.

Then the mayor’s office kicks the press out of a department head briefing on the budget and follows it up with some brief public remarks that show:

1. Newsom would much rather downplay this and say it’s no big deal, and

2. There’s no serious talk about raising new revenues (except from selling off the city’s rental housing stock and creating lots of new condominiums) and

3. Every department is being asked to cut 20 percent and prepare for as much as 30 percent cuts — but that’s going to mean really, really ugly decisions that Newsom can’t possibly make. For example, the Sheriff can only cut 20 percent by letting people out of jail — many of them the same people who Newsom’s new police chief, George Gascon, just put in jail with his much-lauded Tenderloin busts. Then the Tenderloin crackdown will become a joke, because nobody arrested will actually do any jail time, because the city can’t afford to lock them up. Oh, and there won’t be enough cops to arrest them, anyway — unless Newsom has Gascon pull cops out of other, richer neighborhoods to patrol the Loin, which may be a fine idea but will create such political backlash among Newsom’s allies that he won’t dare do it.

And closing fire stations seems to be political poison, so the mayor won’t want to do that.

Which means public health and human services and rec-park will have to cut way more than 30 percent to save police and fire, which means we won’t really have much of a public health, human services or rec-park system any more.

4. The mayor is doing nothing to prepare the public to face the fact of life — we’re going to need significant tax increases, or we’re going to see the devastation of the public service sector in this city.

Welcome back, Gavin.

Oh, and by the way: The last chief executive I remember saying that he didn’t read the newspapers was Ronald Reagan. Great role model. Either Newsom is lying (which I suspect; I can’t believe the mayor of San Francisco actually avoids reading the daily newspaper) or the guy is more out of touch, arrogant and clueless than even I am willing to believe.

Controller, in radical move, defies supes

In a move that’s unprecedented in modern San Francisco history, city controller Ben Rosenfield appears poised to try to block the Board of Supervisors from approving a $7 million supplemental budget appropriation to prevent 500 layoffs of frontline health department workers.

It’s the latest twist in a convoluted battle that pits SEIU Local 1021 and the progressives on the board against the mayor, who wants to lay off nurses aides and clerical workers.

In a budgetmessage posted today, Rosenfield says that the city is running $53 million in the red, and that “until this shortfall is addressed, the Controller’s Office will not be able to certify funds from the General Fund Reserve for other appropriations.”

Rosenfield, a Newsom appointee, is apparently relying on a very old City Charter section that looks like this:

S.F. Charter Sec. 9.113 (d) “General Fiscal Provisions”

No ordinance or resolution for the expenditure of money, except the
annual appropriation ordinance, shall be passed by the Board of
Supervisors unless the Controller first certifies to the Board that
there is a sufficient unencumbered balance in a fund that may legally be
used for such proposed expenditure, and that, in the judgment of the
Controller, revenues as anticipated in the appropriation ordinance for
such fiscal year and properly applicable to meet such proposed
expenditures will be available in the treasury in sufficient amount to
meet the same as it becomes due.

But in my 25 years of covering City Hall, I have never once seen this happen. There have been bad budget deficits before, and supplemental appropriations, and the controller has never told the supervisors that they can’t spend reserve money.

“About the only thing Rosenfield and I agree on is that this has never been done before,” Sup. Chris Daly told me this evening.

The controller’s report notes that several city departments are running over budget — but interestingly, Human Services and Public Health, the targets of the layoffs, are running a surplus of $8.1 million (exactly what the supervisors want to spend).

Among those departments facing shortfalls: The Sheriff’s Office, which is in the red because of “an increase in jail population” — possibly due to the new police chief’s crackdown on drug dealing in the Tenderloin.

I couldn’t reach Rosenfield tonight, but Daly notes that the same legislation was before the board last week, and Rosenfield didn’t object. “So he’s already certified it,” Daly said. “And I’m not sure how he can decertify it now.”

I’m not going to argue that the city has money to burn, but there are always mid-year budget changes in bad times. The supes and the mayor are going to have to make some budget adjustments. But there’s also unanticipated money coming in — for example, San Francisco stands to get about $33 million in federal stimulus money for the Department of Public Health in April, and that funding will be retroactive to the previous year. So this year’s shortfall will actually be $33 million less.

Tina Johnson, a legislative affairs staffer for the state Department of Health Care Services, confirmed the near-certain availability of that money in a Nov. 16th letter to state Sen. Leland Yee.

In any other year, I suspect the controller would follow the normal practice of informing the mayor and the supes that the budget was out of line (as it is, in one way or another, almost every year) and then allow them to come up with some mid-year corrections. But this battle between Local 1021 and the mayor has gotten ugly, and I’m sure there was pressure on Rosenfield.

Look for a showdown at the board meeting tomorrow (Nov. 17). Daly told me that whatever Rosenfield says, “we’re going to have a vote on this.”

The pension fund evictions

In the wake of some big money-losing real estate deals, the California Public Employee’s Retirement System, the largest public pension fund in the nation, is reviewing its investment policies. But it’s too late to help working-class people displaced by two major CalPERS investments.

In 2006, at the height of the real estate bubble, CalPERS put $600 million into real estate deals in New York City and East Palo Alto that, critics say, have led to rent hikes, displacements, and harassment of moderate-income tenants.

The pension fund invested $100 million in Page Mill Properties II, which used the money, along with a sizable bank loan from Wachovia, in a 2006 building-purchase frenzy. The outfit wound up with more than 100 buildings in East Palo Alto — some 1,800 housing units. Another $500 million went to Tishman Speyer Properties and BlackRock Realty, cash that was used in the $5.4 billion deal to snag the Manhattan apartment complexes Stuyvesant Town and Peter Cooper Village.

Those investments are currently teetering on financial ruin. The San Jose Mercury News reported Sept. 9 that Page Mill Properties missed a $50 million dollar balloon payment on its $243 million loan. Now the properties owned by Page Mill are in receivership, placing the landlord’s future and CalPERS’ investment in peril. (Our calls to Page Mill haven’t been returned.)

A Sept. 9 New York Times article quoted real estate analysts predicting that Tishman Speyer and BlackRock would exhaust their funds by December and face loan defaults. A recent New York state court ruling may hold the companies responsible for an estimated $200 million in improper rent overcharges.

Rent overcharges — in violation of rent-control laws — is one piece of what some have labeled "predatory equity" schemes. A May 9, 2008 Times article described the idea: buy rental housing with a lot of middle-income tenants, remove those tenants from rent-controlled units, and re-rent the places to richer people at higher rent. The outcome was supposed to be a quick, profitable return on high-risk investments.

TROUBLE IN EAST PALO ALTO


The Page Mill properties in East Palo Alto border the more affluent neighborhoods of Palo Alto and Menlo Park on the west side of Highway 101. The neighborhood is home to service workers and public employees, many of them people of color. "It’s choice real estate, no question about it. I don’t think Page Mill’s plan was to serve the low-income tenants," Andy Blue of the advocacy group Tenants Together told us.

But local officials haven’t been thrilled with the results. "We are under siege by Page Mill Properties," East Palo Alto Mayor Ruben Abrica told the Mercury News last month. The city is locked in several court battles with the real estate outfit, including two over the city’s rent stabilization ordinance.

A resolution passed by the City Council last year stated that Page Mill had imposed rent increases beyond the 3 percent allowed by the ordinance, and urged CalPERS to intervene.

In an document e-mailed to CalPERS and obtained by Tenants Together, Page Mill claims its rent increases averaged 9 percent. But a class-action suit filed by several Page Mill tenants reported increases of more than 30 percent. A 2008 injunction filed by the city against Page Mill cited increases ranging from 5 percent to 40 percent.

According to the Fair Rent Coalition’s Web site, nearly half the people affected were cost-burdened as defined by government standards — meaning that more than 30 percent of their income already went to rent. The result of the rent increases, according to the city’s resolution, was the displacement of low-income tenants from their homes.

In fact, vacancy rates in East Palo Alto spiked after Page Mill came on the scene. According to numbers crunched by the Fair Rent Coalition and based on 2007 census data, the vacancy rate reached 24 percent in 2008. Before Page Mill started buying up property, vacancy rates were as low as 2 percent. Further, there were 182 evictions between 2007 and 2009 according to the San Mateo County Sheriff’s Office.

RAW DEAL IN MANHATTAN


The Tishman Speyer deal has gotten a lot of press on the East Coast — much of it highly critical. The two massive housing complexes were built for middle-income renters and were one of the few moderate-income communities remaining in Manhattan.

David Jones, president of the Community Service Society of New York, wrote in a Sept. 17 Huffington Post piece that it was the intention of Tishman Speyer to shove aside moderate income to make room for more affluent renters who can afford the higher rents. He called it a "classic example of ‘predator equity.’"

Dina Levy, who works with the New York advocacy group Urban Homesteading, agrees with that assessment. She told us in a phone interview that it was obvious what plans the real estate firms had in mind for the properties.

She said that CalPERS, as a public agency, should have been more careful about getting involved in this sort of investment. She told us that other bankers she talked to thought the deal was toxic and stayed away. "Why would CalPERS put money into a deal that’s predicated on displacing families?" Levy asked.

The Wall Street Journal reported Oct. 23 that CalPERS is extensively reviewing its relationship with Apollo Global Management, which handled a majority of its real estate equity. The fund also issued a new policy on its dealings with placement agents.

But so far, there has been no public investigation of the East Palo Alto and New York investments. Tenancy advocacy groups and East Palo Alto have asked CalPERS to take an active role in the management of Page Mill’s property.

"It doesn’t appear that the human impact of their investments were considered at all as part of this," Tenants Together executive director Dean Preston told us.

Preston’s group is trying to get CalPERS to adopt predator-free investment guidelines — a policy that already has been instituted by New York’s pension fund.

CALPERS DUCKS


In a February letter to Tenants Together, CalPERS called itself a "limited partner in the partnership" and expressed concern over the situation in East Palo Alto, stating that it is reviewing the allegations.

But tenant advocates say the giant fund has been missing in action. "There hasn’t been anything that they’ve told us they’ve been doing or that we’ve seen them do," Preston said.

That hands-off approach appears to violate CalPERS’ stated policies. Two months before allocating funds to Page Mill, CalPERS coauthored and signed the United Nations Principles for Responsible Investment (UNPRI). No. 2 of the six principals states: "We will be active owners and incorporate ESG [environmental, social, and corporate governance] issues into our ownership policies and practices."

CalPERS has been eyeing real estate windfalls since 2002. According to memos and letters given to us by the Fair Rent Coalition, agency staffers that year were discussing an "opportunistic real estate fund." The result of those discussions: discretionary authority given to the senior investment officer for investments up to $100 million, with anything beyond that requiring approval from the chief investment officer.

Paradoxically, the compensation package that rates the senior investment officer’s performance has no provision for the social responsibilities. This coming year’s compensation package now includes a "Best Practices" measure on ethics and risk management. But there’s still no provision for social responsibility.

The California Assembly Committee on Public Employees, Retirement, and Social Security monitors the pension fund, but CalPERS has autonomous authority over its investments. Chief consultant Karon Green told us that the committee is "going to watch to see what the board does and gauge our response based on that."

CalPERS has yet to respond to our inquiries, and hasn’t responded to our public records request for documents pertaining to what Page Mill and its CEO David Taran proposed for the East Palo Alto properties.

Similar requests were made by Tenants Together and the Fair Rent Coalition. CalPERS responded that those documents were confidential, although some e-mails were handed over to the advocacy groups the day before they were to meet with the CalPERS board in December 2008.

Although it calls itself a "limited partner," the e-mails illustrate a closer relationship between CalPERS and Page Mill. In an e-mail to CalPERS, Taran asked for a copy of the public records request made by a San Jose journalist so "we can review them and get back to you regarding what should not be produced and is confidential."

Preston points to the larger policy issue. "If there were a few bad real estate managers who were investing in this, then they should lose their jobs," he said. "But the idea that they just sweep under the rug their $100 million loss in East Palo Alto and their $500 million loss in New York, and whatever other schemes they’re involved in, is just unacceptable."

Christopher Lund, a Page Mill tenant and communications director for the Fair Rent Coalition, agrees. "They’ve gotten burned on some of these high-risk investments over the past year or two. But institutional memory is short and in 10 years when the real estate market is booming, if there’s no transparency and no oversight, this is going to happen somewhere else."

Sanctuary showdown

City Hall echoed with delighted whoops of Si se puede! last week, as a veto-proof majority of the Board of Supervisors voted to give juvenile immigrants their day in court before referring them to federal immigration authorities.

But the battle over the civil rights of immigrant kids is far from over, as Mayor Gavin Newsom, Police Chief George Gascón and U.S. Attorney Joseph Russoniello all insist that they will ignore or defy the city ordinance.

That puts the city in a strange legal position: the supervisors have passed a law that the mayor won’t implement — so it’s not clear what will happen next.

But here’s what is clear — and alarming: under Newsom’s policy, which the sanctuary legislation by Sup. David Campos would overturn, large numbers of immigrant kids are facing possible deportation. U.S. Immigration and Customs Enforcement (ICE) spokesperson Virginia Kice told the Guardian that 150 juveniles from San Francisco have been referred to ICE since June 11, 2008 when Newsom began requiring that the city’s probation officials refer youth to ICE on arrest.Of those, 114 have come into federal custody (and may be facing deportation). Campos, who came to this country from Guatemala as an undocumented teen, said his legislation is a "balanced response" to the shift in sanctuary policy

Under Newsom’s policy, city probation officials are required to refer juveniles booked on a felony and appear undocumented to ICE at the time of arrest.

But under Campos’ amendment, ICE referral would not occur unless a juvenile justice court finds the youth guilty as charged.

Mayoral spokesperson Nathan Ballard short-circuited the immigrant community’s hopes for due process by announcing that Newsom simply plans to ignore Campos’ legislation.

"The Campos bill isn’t worth the paper it’s written on — it’s unenforceable and he knows that," Ballard told the San Francisco Chronicle.

Campos says that’s nonsense. "The whole point of having a sanctuary ordinance is that we choose not to be in the business of federal immigration enforcement," Campos said. "We are not an arm of ICE."

In a phone interview, Russoniello told the Guardian that Newsom’s policy accords juveniles due process at the federal level, and that federal immigration authorities are not interested in going after people who are obeying laws or are simply out of status.

"Our focus is guns, gangs, and drugs," Russoniello said. "But people who are detained should have no expectation that they will not be deported."

In other words, kids who are arrested on felony charges — who may not be guilty — could be deported anyway.

"Juvenile Probation Department alerts ICE when an individual comes in that they believe may be a deportable juvenile alien," Kice said. "We dispatch an officer to interview the juvenile, elicit biographical information, and do background checks to see if they have a legal basis for being in the country."

So where are the kids Newsom has turned over in the past year? Hard to say. Kice said the federal Human and Health Services’ Office of Refugee Resettlement is responsible for ensuring that kids receive appropriate care and protection. "We no longer deal with the custody issues related to juvenile cases," Kice added.

Russoniello said he doesn’t know the whereabouts of the 114 juveniles placed in federal custody since Newsom’s policy took effect in June 2008, but dismissed such concerns as "pretextual."

"Before June 2008, the city’s pretext for sending [Honduran teenagers] back home was to reunite them with their family. Now the complaints are they are being ripped away from their families," he said. "The Campos legislation is mute, it’s irrelevant, and it’s contrary to federal law, and I think the mayor and the chief of police both agree."

Chief Gascón, concerned about the lack of due process and kangaroo courts at the federal level that he experienced as police chief in Mesa, Ariz,, recently told the Guardian he hoped to see Campos and Newsom find a compromise.

Gascón, who was appointed by the mayor, now says he believes Newsom’s hands are tied because of federal laws. "I don’t think the mayor has a choice," Gascón told the Chronicle.

But Sheriff Mike Hennessey, whom ICE pressured to amend his department’s policy toward immigrant detainees last year, thinks the Campos amendment is reasonable. "I don’t think we want to be reporting people who aren’t worthy of prosecution," Hennessey said. "Federal law says that if a probation officer violated the Campos’ amendment, they could not be penalized, under federal law," Hennessey explained. "That’s different from saying they are mandated to report juveniles to the federal authorities."

Juvenile Probation Department Chief William Siffermann told the Guardian that his agency "will continue to discharge its duties and responsibilities in a manner that conforms with all laws and await the outcome of the San Francisco legislative process."

"At the conclusion of that, we will confer with the city attorney and outside legal counsel around any impacts this would have on existing protocols."

Fighting for juvenile justice

Sup. David Campos’ proposal to amend San Francisco’s sanctuary policy so that the city guarantees due process to juvenile immigrants heads for a full vote of the board next week with the support of a veto-proof majority of supervisors.

Board President David Chiu and Sups. John Avalos, Chris Daly, Bevan Dufty, Eric Mar, Sophie Maxwell, and Ross Mirkarimi have signed on as cosponsors of the amendment, which also has the support of a broad coalition of civil and immigrants’ rights organizations.

But with the mayor opposed to the bill and the daily newspapers agitating against reform, it’s important to remember what’s really at stake here.

As a team of civil rights experts notes, the Campos bill "will ensure that families are not torn apart because a youth is mistakenly referred for deportation and will encourage cooperation between law enforcement and immigrant communities by reestablishing a relationship based on trust, therefore increasing public safety."

Campos, who came to this country as an undocumented youth from Guatemala and represents San Francisco’s heavily immigrant Mission District, says his proposal is a balanced solution to the draconian policy Newsom ordered last summer, without public input, the day after the mayor launched his 2010 gubernatorial bid.

When Campos introduced his amendment this summer, after months of public conversations with law enforcement agencies and the immigrant community, Newsom responded by leaking a confidential legal memo that outlined possible challenges to the proposal.

Angered but undaunted, a group of civil rights organizations responded by issuing their own brief explaining why Campos’ proposal is legally tenable and defensible.

As Angie Junck of the Immigrant Legal Resources Center, Robert Rubin of the Lawyer’s Committee for Civil Rights, Julia Mass of the American Civil Liberties Union of Northern California, professor Bill Ong Hing of UC Davis Law School, and Angela Chan of the Asian Law Caucus explained, Campos’ proposal "will allow immigrant youths to have their day in court and be heard by an impartial judge, ensuring due process is upheld for all of San Francisco’s youth."

They argue that Campos’ legislation seeks to "lessen the risk that the city will be liable for racial profiling, unlawful detention, and mistaken referrals of U.S. citizens and lawful immigrants for deportation while bringing the city’s juvenile probation practices into compliance with state confidentiality laws for youth."

And as they point out, Campos’ proposal won’t prevent youths who have been found by a court to have committed a felony from being referred to ICE.

"The sanctuary ordinance has stood strong for 20 years, and the proposed amendment strengthens the ordinance by taking steps to bring the city’s practices more into compliance with state juvenile justice law," the brief states. "The legislation is a measured step in the right direction that will help restore accountability and fairness in the city’s treatment of immigrant youth."

Or as Campos put it: "It’s something we drafted very carefully in close consultation with the City Attorney’s Office."

ARRESTED OR CONVICTED?


Campos’ amendment seeks to shift the point at which immigrant kids get referred to ICE agents for possible deportation. Newsom’s policy allows the police to refer kids to ICE the moment they’re arrested. That means someone who turns out to be innocent and was arrested in error can still be deported. Campos wants the cops to wait until the felony charge is upheld in juvenile court.

Since July 2008, when Newsom ordered the city’s current policy shift, 160 youths have been referred to ICE, increasing the risk they will be sent to detention facilities across the country, far from their families, without access to immigration legal services, based on accusations and racial profiling.

Abigail Trillin, staff attorney with the Legal Services for Children, told us that the Newsom policy makes San Francisco bedfellows with Texas and Orange County.

"A bunch of our kids go to Yolo County and Oregon, a lot to Los Angeles, others to Miami, Virginia, and Indiana, and some have already been deported," Trillin said.

Trillin noted that Newsom’s policy is destroying families by allowing innocent kids to be reported for deportation without the basic right to due process — often for minor offenses. She has already seen youth who are documented or innocent erroneously referred to ICE by juvenile probation officers, who often lack expertise in immigration law.

She also fears this miscarriage of justice could result in abuse and even death — especially if kids try to return to their homes and families by crossing the border, which has became increasingly militarized and perilous in the aftermath of the Bush administration’s decision to spend billions to build a fence along the border.

Last week, the battle for juvenile justice took a fresh twist locally when Newsom’s newly appointed Police Chief George Gascón said he hoped for a compromise involving third party review by the District Attorney’s Office.

"I fully understand the concerns Campos brings to the table," Gascón said, referring to his previous job as chief of police in Mesa, Ariz., where he saw the anti-immigrant excesses of Maricopa County sheriff Joe Arpaio.

"I have the benefit of seeing the other side, where you have police agencies aggressively engaged in immigration enforcement, where people that were frankly not engaged in any criminal activity other than that of being here without authority, are being deported," Gascón said. He noted that being here without papers often is not a crime; it’s just an administrative violation.

"I’ve seen very young people, people that basically came to this country when they were three or four years old and are staying clean and going to school, get stopped for a traffic violation at age 17 or 18, and now all of a sudden they’re getting deported to a country where they have no roots," he said.

But the chief remains convinced that the criminal justice system needs to be able to use all legally available tools to deal with violent criminal juveniles.

"I’m not saying the district attorney needs to make the reporting. The triggering event could be the determination to file the case," Gascón said. "Frankly, I wish I’d been here a year earlier to deal with this issue," he added, noting that federal immigration hearings are "a kangaroo court."

"It’s not a beyond-reasonable-doubt standard for people to get deported," he said.

"The other side of the coin is that this would be putting people in situations where they could be federally indicted for violations of law. And you also have problems at state," he continued, noting that two federal grand juries are currently reviewing the behavior of the Juvenile Probation Department.

DUE PROCESS


Campos, a lawyer, appreciates that the new police chief is "genuinely trying to see if there is something he can do to resolve the situation. I believe if he had been in place where this discussion was going on a year ago, the mayor would have received better advice."

"The chief’s comments reflect that what is happening here is pretty extreme," Campos added. "I recognize that changing the reporting process to a third party would definitely be better than what we have now, where the final decision rests with a police officer. But while it’s better, it’s not sufficient. Due process necessarily entails giving people their day in court, and letting a judge decide what actually happens."

Sup. Chiu, a former prosecutor, also said he appreciates Gascón’s resolution attempt. "But the point of our system is that once you are arrested and charged, there are due process rights so you can respond to those charges."

Sup. Dufty, a mayoral candidate, said he expects that when the board passes laws, those laws will be implemented by Newsom. "As CEO of San Francisco, he has to comply with all legislation, including local laws the legislative body passes that he may not like," Dufty said.

"My mother was born in Czechoslovakia and was stateless when I was a boy," he added. "She had to register every year as an alien, so this is very visceral for me. If we are to be a sanctuary city, it’s because everyone has due process. It’s denying people’s humanity and dignity and creating a two-tiered system for justice."

But mayoral spokesperson Nathan Ballard continued to assert that Newsom’s current policy is balanced. "While he remains open to argument, the mayor believes the current policy strikes the right balance between protecting public safety and safeguarding the rights of accused criminals," Ballard, who had not replied to the Guardian‘s questions as of press time, told the Examiner last week.

But Trillin says she can’t stand to hear Ballard falsely claim, one more time, that the city is going to shield criminals. "Ballard keeps repeating a completely false position, because Newsom’s actual position is morally indefensible," Trillin said. "You can’t have the mayor publicly say that young people don’t deserve due process, so you have to make up stuff like this instead."

New coach, new approach

The chief was running late. As a group of Guardian reporters filed into his modest, comfortable conference room on the fifth floor of the Hall of Justice, an aide told us that Police Chief George Gascón was still meeting with Mayor Gavin Newsom at City Hall, and that we’d all have to cool our heels for a while.

While we were waiting, Michelangelo Apodaca, a public affairs officer in the chief’s office (he called himself an “image strategist”) stressed the recent sea change at SFPD, labeling it “new coach, new approach.” (It appears, however, that the mayor is still pushing his so-called “quality of life” agenda. “I just came from a meeting where I got beat up for not doing enough about public drinking and public disorder,” the chief belatedly told us.)

But once we got into the interview, Gascón was friendly, candid, thoughtful, and accommodating, and spent nearly an hour discussing his philosophy of law enforcement, his vision for San Francisco, and his positions on some tricky and divisive problems.

We left with the impression that the new chief, although hardly in agreement with us on a number of issues, is far more open than his predecessor, willing to shake things up in the moribund department — and sometimes, interested in discussion and compromise on progressive concerns.

“My philosophy of policing is very heavy in community involvement, very transparent,” Gascón told us.

Gascón said he’s moving quickly on implementing many of the items that he’s promised, such as creating a COMPSTAT (computerized crime and staffing statistics) system that will be accessible to the public. He plans to launch it Oct. 21.

And beyond the technology, he seems interested in shifting the top-down structure of the department. “I said that we would reorganize the department in certain levels and do certain levels of decentralization to increase resources at the neighborhood level so that we actually have people within the police department who have greater ownership of neighborhood issues,” he said. “And we’re going to do that in November. I stated that we would have community police advisory boards at each of the stations, and those basically will be neighborhood-level people, anywhere from 10 to 20, for each station. We’ll work with our local captains on neighborhood-related issues.”

He said that improving how the department does community policing will have a two-fold impact. “One is, the cops get to understand better what the community really wants. The other is that the community gets to understand better what the resources really are.

“Everybody wants a foot-beat cop,” he continued. “Everybody wants a fixed-post cop. Everybody wants a cop in every bus. If we had 10,000 people, then perhaps we could fulfill all those wishes. The reality is that we don’t.”

 

EXPENSIVE CRACKDOWN

But the most tangible impact of Gascón’s tenure so far has been his crackdowns on drug-related activity in the Tenderloin, where more than 300 people at a time have been swept up in sting operations, and on marijuana-growing operations in the Sunset District, where 36 locations were raided (four of which Gascón said were discovered to be “legitimate” medical marijuana growers who had their crops returned by police).

The arrest surge generated a lot of positive press — but also is costing the city a bundle. Sheriff Michael Hennessey, who runs the county jail, told us that he had to reopen several jail housing units that had been slated to close to meet his budget for the current fiscal year. He said the average daily jail population in July was 1,861, but that it has risen to 2,146 in September, a 285 inmate increase.

If it stays at this level, Hennessey estimates that he’ll need up to $3.5 million in additional annual funding to house the larger population, as he indicated in a letter that he wrote to the Board of Supervisors last month, letting them know that he will probably need a supplemental budget appropriate this year.

When we asked Gascón whether affected city agencies — including the Sheriff’s Department, District Attorney’s Office, and Public Defender’s Office — should increase their budgets to deal with the SFPD’s new approach, he said they should.

There’s a touch of the corporate manager about Gascón. When we challenged him to defend the efficacy of the crackdowns, Gascón pulled out a pen and paper and started drawing a Venn diagram, with its three overlapping circles. He explained that many criminal justice studies have shown that about 10 percent of criminal suspects commit about 55 percent of the crime, that 10 percent of crime victims are the targets of about 40 percent of crimes, and that crime is often concentrated in certain geographic areas.

By concentrating on the overlap of these realms, Gascón said police can have a major impact on crime in the city. Although Gascón admits that “police can never arrest themselves out of social problem,” he also said “there are people who do need to be arrested … Most of the arrests are for serious felonies.”

It’s a potentially tricky approach — in essence, Gascón is saying that when you mix some people and some places (in this case, mostly people of color and mostly poor neighborhoods) you create crime zones. The difference between that and racial profiling is, potentially, a matter of degree.

But Gascón defended the surge in arrests over the last two months as targeting those who need to be arrested and, just as important, sending a message to the greater Bay Area that San Francisco is no longer a place where open-air drug dealing, fencing stolen goods, and other visible crimes will be tolerated.

“We need to adjust the DNA of the region,” he said.

And while Gascón said the arrest surge might not be sustained indefinitely, he also frankly said that the city will probably need to spend more money on criminal justice going forward. In other realms of the recent crackdown, such as the police sweeps of Dolores Park and other parks ticketing those drinking alcohol, Gascón said that was more of a balancing act that will involve ongoing community input and weighing concerns on both sides of the issue.

It was when we pushed for the SFPD to ease up busting people in the parks who were drinking but not causing other problems that Gascón told us that the mayor had a different opinion and had been chiding his new chief to be tougher on public drinking.

In light of several recent shootings by SFPD officers of mentally ill suspects, we asked Gascón whether he’s satisfied with how the department and its personnel handle such cases. He didn’t exactly admit any problems (saying only that “there’s always room for improvement”) but said he was concerned enough to create a task force to investigate the issue last month, headed by Deputy Chief Morris Tabak.

When we asked if we can see the report on the 90-day review, Gascón didn’t hesitate in answering yes, “the report will be public.”

 

FIRE TEN COPS?

If Gascón follows through with his promises, internal discipline — one of the worst problems facing the department — could get a dramatic overhaul. The new chief wants to clear up a serious backlog of discipline cases, possibly by reducing the penalties — but claims to be willing to take a much tougher stand on the serious problem cases.

In fact, Gascón said he wants the authority to fire cops — that power now rests entirely with the Police Commission — and said there are eight to 10 police officers on the San Francisco force who should be fired, now, for their past record of bad behavior. That would be a radical change — in the past 20 years, fewer than five officers have ever been fired for misconduct, despite the fact that the city has paid out millions in legal settlements in police-abuse cases.

Gascón also discussed controversial legislation by Sup. David Campos that would require due process before undocumented immigrant youths arrested by the SFPD are turned over to federal immigration authorities, an amendment to the sanctuary city policy that was weakened by Newsom.

Just days after arrived in town, Gascón had made comments to the San Francisco Chronicle supporting Newsom’s position and saying that under Campos’ legislation, “drug or even violent offenders could be released by judges on reduced charges in lieu of reporting them for possible deportation.”

But in the interview with us, while not backing away from his previous statement, Gascón seemed to take a more nuanced position that pointed toward the possibility of compromise. He reminded us that he’d spent time in Mesa, Ariz., tangling with a county sheriff, Joe Arpaio, who has gone far beyond any reasonable standard in trying to arrest and deport undocumented residents. He also told us that he doesn’t think the cops, by themselves, should decide who gets turned over the feds for deportation.

That alone is a significant step — and suggests that Gascón could turn out to be one of Newsom’s best hires.

GASCON ON IMMIGRATION

SFBG Are you still concerned about waiting for the courts to determine a suspect’s guilt before turning him over to the feds? Gascón Yes, it’s very much a concern. And by the way, I fully understand the concerns Sup. David Campos brings to the table.

I have the benefit of being on the other side also, where you have police agencies aggressively engaged in immigration enforcement, where people that frankly were not engaged in any criminal activity other than being here without authority — which sometimes, by the way, is not criminal. In fact, depending on whose numbers you listen to, anywhere from 30 to 50 percent of people who are here without authority in this country have not committed a criminal violation; they have committed an administrative violation.

And people get deported. I have seen very young people, people that basically came to this country when they were three, four years old, they are actually staying clean, they are going to school, and they get stopped for a traffic violation at age 17 or 18, and now all of a sudden they are getting deported to a country where they really have no roots at all. I have seen that, and I’m very sensitive to that.

On the other hand, I think it’s important also to recognize that in any group, whether you were here legally or not legally, whether you were born here or not, whether you are green, red, or brown, there are people that for a variety of reasons aren’t willing to live by the social norms we all need to live by to be able to have a peaceful environment.

I think that allowing the process to go all the way to the point where a judge decides whether to allow this to continue … is probably too far down the food chain for my comfort level. On the other hand, I would not want to have police officers on the streets stopping people and trying to assess whether they are here legally or not.

So I think we need to find somewhere down the middle, that if person is arrested, there is a non-law enforcement review. And quite frankly, probably the best person would be the D.A. They determine whether they have a prosecutable case or not. If it’s prosecutable case and a predictable offense that requires reporting, then that would be a good time where a flag could go up.

SFBG But that’s not the process right now.  Gascón No, the process now is triggered by the Probation Department, which is a law enforcement entity. So I think we have a process where law enforcement is making a decision and Sup. Campos is looking at a process of adjudication.

SFBG It sounds as if you agree substantially with Sup. David Campos. Is there room for compromise? 

Gascón I’m hoping there is room for compromise, that is something we’re trying to work with.

Prison report: CDCR won’t admit mistakes

It was a good week for Jaycee Dugard, who was discovered after being imprisoned for 18 years in an Antioch backyard. But it wasn’t a good week for the Contra Costa County Sheriff’s Office, which missed several opportunities to solve the case, including two visits to the home of Phillip Garrido, the paroled sex offender who is charged with kidnapping Dugard.

But at least Contra Costa Sheriff Warren E. Rupf had the courage to admit the mistakes, ask forgiveness and take steps to assure that something like this would never happen again.

What was the California Department of Corrections and Rehabilitation response? Remember, CDCR is responsible not only for people in prison but for people on parole. In typical fashion, agency spokesman Gordon Hinkle denied that anything had gone wrong or that CDCR had been remiss in any way, and said that that the parole agent had gone in Garrido’s backyard but because of the way it was situated didn’t find anything strange.

Wait: These agents visited a registered sex offender’s house once a month, yet found nothing awry?

Far be it for the people at CDCR to even admit that they are doing a poor jobs. They never admit responsibility for anything. Yet they are tasked with rehabilitation.

Isn’t a key component of the rehabilitation process admitting your mistakes? What kind of example does it set when the entity so concerned about the public’s safety is incapable of admitting it has done something wrong performed poorly?

Examples like this should make it obvious that CDCR is not protecting you but protecting itself through a continuous enterprise of lying, hiding the truth, covering up the facts and skewing information in order to paint a picture or inmates as unrepentant evildoers bent on destruction — while coloring itself as a benign bureaucracy with the unenviable job of keeping us at bay by “walking the toughest beat.”

The beat is so “tough” that the parole agents didn’t thoroughly investigate the back yard of a convicted sex offender. I guarantee my parole officer would investigate my back yard if it were in such disarray – at the very least, the yard was ripe to be a meth lab and Garrido’s deranged rants would be a cause for concern.

But you know what one of the big problems with the scenario is? The parole agent probably had 200 people to watch, 100 of them no nonviolent offenders, so he or she didn’t have time to thoroughly investigate what was going on.

Wait – it was 18 years! Good job, CDCR.

Government’s number on priority is to protect the public, but with that comes a responsibility to define what the public is being protected from. Do we really need to be protected from a casual drug user, or even addict (any more than we need to be protected from a casual drinker or even an alcoholic)? If drugs were decriminalized, taxed and regulated by the FDA — or even handed out free to registered addicts – a large percentage of our property crimes would disappear. The black market would collapse, prices would drop and drug-related murders would decline.

But most important, parole officers wouldn’t have to be so overwhelmed that they don’t have the time to investigate the jungle-like backyard of a convicted rapist who believes he was inspired by God to commit atrocities on teenage girls.

Journalist bruised by Deputy Sheriff while trying to film Supervisors meeting

Luke Thomas, the journalist behind the popular San Francisco blog Fog City Journal, posted this YouTube video yesterday documenting how a Deputy Sheriff forcefully removed him from the Board of Supervisors Chambers while he was filming a commendation ceremony held during the Board meeting.

According to Thomas, Deputy Sheriff Thompson “dug his left hand fingers into my right side that caused an [excruciating] pain and literally pulled me by my skin and flesh outside Board chambers like a dog on a leash.” The incident began when the Deputy Sheriff told the cameraman to back up from a line of Aztec dancers who were performing, to which Thomas says he complied. But when he was told to step back a second time, Thomas says he complained that he was being prevented from documenting the event. That’s when the Deputy Sheriff grabbed him, Thomas recounts. “It shocked the hell out of me,” the photojournalist told the Guardian later. “I can’t imagine what was wrong with this guy. It was completely unwarranted.”

In the video, Thomas can be heard telling the Deputy Sheriff in disbelief, “Dude, you just assaulted me.”

Eileen Hearst, a spokeswoman for the Sheriff’s Department, told us that “the photographer was getting in the way of the Aztec dancers. He was asked several times to please step away from them. He did not.” When asked whether the use of force was warranted in this case, Hearst said, “If [Thomas] feels it was unduly forceful, he … can call the investigative services unit, and we’ll take a look at it.”

The Fog City Journal blogger wasn’t issued a citation. “At the end of it all, [Thompson] capitulated and apologized for what he did,” Thomas told us.

Thomas says the incident left him with “a quarter sized area of broken skin surrounded by reddish contusions.”

Fireworks at the DCCC

The San Francisco Democratic County Central Committee heard a resolution urging city agencies to not privatize city services last night. It’s the sort of measure that would normally pass without much debate — the local Democratic Party has always taken the side of the unions on contracting-out disputes.

But in the midst of the budget mess, the head of the firefighters’ union, John Hanley, showed up to berate the committee members, some of whom are also supervisors, over the latest budget moves.

As Hanley raged about putting firefighters’ lives on the line, committee chair Aaron Peskin and other members tried to make the point of order that this resolution was about privatizing city services, not changes to the budget. Hanley raised his voice louder yet, and, with his face a deep shade of red, he waved a pointed finger around as he yelled about $80 million in cuts.

At that point DCCC member and supervisor Chris Daly rose from his chair and pointing his finger at Hanley demanded, “Don’t point at me!” Hanley became even further agitated, and some committee members demanded that both Daly and Hanley leave. Both then ultimately quieted down, and neither was forced to leave.

In spite of the jarring display and repeated attempts to bring the focus back to the privatization of city services, commenters continued to speak on budget concerns. Former DCCC member and Deputy Sheriff David Wong said the Democratic Party should be for working people, and asked to not have the sheriff’s budget cut. Committee member Robert Haaland asked him if he supported or opposed contracting out sheriff services, but Wong didn’t answer.

Several SEIU members and Department of Public Health workers followed, speaking of seniors missing meals, nursing-to-staff ratios at SF General that result in less skilled workers doing responsibilities above their level of training, and even clients who had just been killed while on a wait list for city services.

When public comment closed, committee members addressed the hotly contended budget decision in a general way. Peskin began, “I want to refute the politics of fear and demagoguery,” referring to Hanley’s intimidating style of speaking. “There’s no question the pie has shrunk,” he continued, reiterating that in a fundamental notion of fairness, all departments must share the pain.

Haaland noted that 1,500 people would be laid off in the Department of Public Health, and that just wouldn’t be true of all departments. He said that cutting the DPH by $100 million would gut the Healthy San Francisco program, and result in $4 million cut from HIV services.

Peskin followed, declaring flatly, “I don’t want my house to burn down either.” He urged everyone to be part of the solution.

The members moved to take out language referring to specific professions that might be privatized, and with those changes, overwhelmingly passed the resolution against privatizing city services.

Dueling rallies pit “public safety” against “safety net”

Mayor Gavin Newsom joined the city’s police, fire and sheriff departments yesterday afternoon in protesting the Board of Supervisors’ move to slash funding to those departments in order to restore cuts to critical services that the mayor had included in his interim budget.

In essence, the mayor was sending a very divisive message, pitting one set of city employees against another. Because just a few yards away from Newsom’s rally, health and human service employees were holding an event of their own.

Standing upon a stage equipped with a very loud sound system and decorated with American flags, Newsom praised police and firefighters for being willing to step up and be part of the solution to the budget crisis. He was greeted warmly by cheering and drumming, and before they introduced him they blasted a song with the lyrics “A family affair.”

Across the street, public-health workers were joined by Sup. John Avalos in their own rally against the deep cuts to the department of public health. “All we’re asking is to give a little so that we can share the pain of this deficit,” Avalos said.

The most painful and divisive city budget season in many years was just getting under way as this issue went to press, with dueling City Hall rallies preceding the June 16 Board of Supervisors vote on an interim budget and the board’s Budget and Finance Committee slated to finally delve into the 2009-10 general fund budgets on June 17.

Both sides have adopted the rhetoric of a life-or-death struggle, with firefighters warning at a rally and in an advertising campaign that any cuts to their budget is akin to playing Russian Roulette, while city service providers say the deep public health cuts proposed by Mayor Gavin Newsom will also cost lives and carry dire long-term costs and consequences.

Despite Newsom’s pledges in January and again on June 1 to work closely with the Board of Supervisors on budget issues, that hasn’t happened. Instead, Newsom’s proposed budget would decimate the social services supported by board progressives, who responded by proposing an interim budget that would share that pain with police, fire, and sheriff’s budgets — which Newsom proposed to increase.

Rather than simply adopting the mayor’s proposed budget as the interim spending plan for the month of July, as the board traditionally has done, progressive supporters proposed an interim budget that would make up to $82 million in cuts to the three public safety agencies and use that money to prevent the more draconian cuts to social services.

“It’s the start of a discussion to figure out what that number should be. I don’t know where we’re going to end up,” Sup. David Campos, who sits on the budget committee, told us.

Board President David Chiu said Newsom did finally meet with him and Budget Committee chair John Avalos on June 15 to try to resolve the impasse. But he said, “We didn’t hear anything from the mayor that would change where we were last week.” They planned to meet again on June 19.

“What we proposed represents the magnitude of the challenge we face this year,” Chiu said of the interim budget proposal, seeming to indicate that supervisors are open to negotiation.

The real work begins the morning of June 17 when the Budget and Finance Committee dissects the budgets of 15 city departments, including the Mayor’s Office, of which Avalos told us, “I don’t think the mayor has made the same concessions as he’s had other departments make.”

The next day, another 13 city departments go under the committee’s microscope, including the public safety departments that were spared the mayor’s budget ax and even given small increases, and the budget of the Public Defenders Office, where Newsom proposes cutting 16 positions.

“This creates a severe imbalance in the criminal justice system,” Public Defender Jeff Adachi told us. “Why is he cutting public defender services while fully funding police, fully funding the sheriff’s department, and essentially creating a situation where poor people are going to get second-rate representation?”

That theme of rich vs. poor has pervaded the budget season debate, both overtly and in budget priorities that each side is supporting.

 

BUDGET JUSTICE

Hundreds of people whose lives would be affected by cuts marched on City Hall under the banner Budget Justice on June 10. Some of San Francisco’s most vulnerable citizens, including homeless people, immigrants, seniors, and public housing residents, turned out for the march, chanting and waving signs asking the mayor to “invest in us.”

Sups. John Avalos and Chris Daly delivered resounding speeches mirroring the anger in the crowd, and promised to fix the budget by reallocating money to protect the city’s safety net. Daly charged that even as services to the city’s vulnerable populations are being slashed, “the politically connected and the powerful get huge increases.”

Avalos took the podium just before heading into City Hall to lead the Budget and Finance Committee meeting and implored the hundreds of people gathered out front to make their voices heard. “Mayor Newsom, he told us, he said, ‘We have a near-perfect budget.’ Do we have a near-perfect budget?” Avalos asked, and then paused while the crowd cried out, “Nooo!!!!!”

During an interview discussing Newsom’s budget priorities, Avalos twice made references to The Shock Doctrine, using the Naomi Klein book about how crises are used as opportunities to unilaterally implement corporatist policies. “We have a budget deficit that is real, but it’s being used to do other things,” Avalos said. “I look at it as a way to remake San Francisco. It’s a Shock Doctrine effect.”

He referred to the privatization of government services (an aspect of every Newsom budget), promoting condo conversions and gentrification, defunding nonprofits that provides social services (groups that often side with progressives), and helping corporations raid the public treasury (Newsom proposed beefing up the Mayor’s Office of Economic and Workforce Development by a whopping 32 percent).

“It’s things that the most conservative parts of San Francisco have wanted for years, and now they have the conditions to make it happen,” Avalos said.

Much of that agenda involves slashing services to the homeless and other low-income San Francisco and de-funding the nonprofit network that provides services and jobs. “There’s an effort to say nonprofit jobs aren’t real jobs, but they are an important economic engine of the city,” Avalos told us. Those cuts were decried during the June 10 budget rally.

“What people don’t realize,” Office & Professional Employees International Union Local 3 representative Natalie Naylor said, “is that everything that’s being proposed to be cut from the city is creating no place for homeless people to go during the daytime. I don’t think Newsom’s constituents realize that we’re going to see more homeless people on the street than ever before.”

Pablo Rodriguez of the Coalition on Homelessness told the crowd that he was furious that the mayor would make such deep cuts to social services. “Stop riding on the back of the homeless, and the seniors and the children and all the community-based organizations,” Rodriguez said. “Why make the poor people pay for the rich people’s mistakes? The poor people didn’t make the mistakes.”

 

WHOM TO CUT?

The public safety unions were equally caustic in their arguments. An announcement for the Save Our Firehouses rally — which was heavily promoted by members of the Mayor’s Office and Newsom’s gubernatorial campaign team — claimed that “the Board of Supervisors voted to endanger the progress that we’ve made in public safety by laying off hundreds of police officers, closing up to 12 out of 42 fire stations and closing part of our jail.”

Actually, all sides have said the interim budget probably won’t lead to layoffs, station closures, or prisoner releases, but those could be a part of next year’s budget.

Tensions temporarily cooled a bit in the days that have followed, but the two sides still seemed far apart on their priorities, mayoral spin aside. Asked about the impasse, Newsom spokesperson Nate Ballard told the Guardian, “The mayor has already included over 90 percent of the supervisors’ priorities in the budget. But he’s against the supervisors’ efforts to gut public safety. He’s willing to work with people who have reasonable ideas to balance the budget. Balancing the budget with draconian cuts to police and fire is unreasonable.”

Campos disputed Ballard’s figure and logic. “I don’t know where that number comes from,” Campos said. “A lot of the things we wanted to protect, the mayor cut anyway.”

Campos said Newsom’s slick budget presentation glossed over painful cuts to essential services, cuts that activists and Budget Analyst Harvey Rose have been discovering over the last two weeks. “I felt the mayor has done a real good job of presenting things to make it look like it’s not as bad as it really is,” Campos said.

 

COMMITTEE WORK

Avalos expressed confidence that his committee will produce a document to the full board in July that reflects progressive priorities.

“We’re going to pass to the full board a budget that we have control over,” Avalos said, noting that a committee majority that also includes Sups. Campos and Ross Mirkarimi strongly favors progressive budget priorities.

He also praised the committee’s more conservative members, Sups. Bevan Dufty and Carmen Chu, as engaged participants in improving the mayor’s budget. “I think the tension on the committee is healthy.”

Ultimately, Avalos says, he knows the board members can alter Newsom’s budget priorities. But his goal is to go even further and develop a consensus budget that creatively spreads the pain.

“Ideally, I want a unanimous vote on the Board of Supervisors,” Avalos said.

In the current polarized budget climate, that’s an ambitious goal that may be out of reach. But there are some real benefits to attaining a unanimous board vote, including the ability to place revenue measures on the November ballot that can be passed by a simply majority vote (state law generally requires a two-third vote to increase taxes, but it makes provisions for fiscal emergencies, when a unanimous Board of Supervisors vote can waive the two-thirds rule).

Avalos has proposed placing sales tax and parcel tax measures on the fall ballot. Other proposals that have been discussed by a stakeholder committee assembled by Chiu include a measure to replace the payroll tax with a new gross receipts tax and general obligation bond measures to pay for things like park and road maintenance, which would allow those budget expenses to be applied elsewhere.

But Avalos said Newsom will need to step up and show some leadership if the measures are going to have any hope of being approved. “To get the two-thirds vote we need to win a revenue measure in this bad economy is going to be really hard,” Avalos said.

“The mayor is open to new revenue measures as long as they include significant reforms and are conceived and supported by a wide swath of the community including labor and business,” Ballard said.

Sup. Sean Elsbernd — one of the most conservative supervisors — has repeatedly said he won’t support new revenue measures unless they are accompanied by substantial budget reforms that will rein in ballooning expenditures in areas like city employee pensions.

“Pension reform. Health care reform. Spending reform. One of the above. A combination of the above,” Elsbernd told the Guardian when asked what he wants to see in a budget revenue deal.

Avalos says he’s mindful that not every progressive priority can be fully funded as the city wrestles with a budget deficit of almost $500 million, fully half the city’s discretionary budget. “It’s a crappy situation, and we can make it just a crummy situation.”
