Gen. David H. Petraeus, the top American military commander in Iraq told Congress this afternoon that the United States should be able to reduce its troop strength to what it was before the recent increase and that it could be done without jeopardizing the hard-won progress made in Iraq, according to the New York Times.

U.S. military:

9 U.S. soldiers were killed today in and around Baghdad, all but one were killed in vehicle accidents, according to the San Francisco Chronicle. This wave of U.S. military fatalities occurred on the same day that U.S. Ambassador Ryan Crocker and top commander Gen. David Petraeus began a series of appearances before Congress to report on the situation in Iraq since President Bush ordered nearly 30,000 extra troops to Iraq this year.

Paging Dr. Sumchai

If mayoral candidate Ahimsa Porter Sumchai were a superhero, she’d be Rescue Girl, her petite athletic form encased in a silver jumpsuit and cape as she swooped in, using her understanding of complicated medical and scientific issues as her secret weapon, to save high-risk communities from environmental racism, economic disenfranchisement, and social displacement.

Instead, she’s the candidate who claims to be thankful her name was excluded from the San Francisco Chronicle‘s Aug. 11 coverage of the mayor’s race, in which Gavin Newsom’s challengers were dissed as a peanut gallery of lunatics.

"I’m glad the Chronicle did not disrespect me in the context of ‘a chicken, a wolf, and a grasshopper’-style jokes, like the race is a big laugh," says Sumchai, 55, as I pick her up at the corner of Third Street and Palau Avenue, which lies a stone’s throw from Sumchai’s campaign headquarters in the heart of Bayview–<\d>Hunters Point and a five-minute drive from the Environmental Protection Agency’s Superfund site at the Hunters Point Shipyard.

This intersection was the main drag for Navy operations when the shipyard was active, Sumchai explains as we pass rows of tightly packed houses and a sprinkling of churches — including Grace Tabernacle Church, which has recently become a rallying point for hundreds of residents concerned about exposure to toxic asbestos dust at Lennar Corp.’s Parcel A redevelopment work site at the shipyard.

Sumchai has made that exposure a central focus of her campaign.

"When I become mayor, Lennar will shut down at Parcel A, and I will establish a plan that includes a human safety component and testing of potentially exposed residents," says Sumchai, who also opposes what she calls "the dirty transfer of the shipyard," through which Newsom has proposed folding Candlestick Point into the shipyard so he can build a stadium for the 49ers — and Lennar can build 6,500 more condos at Candlestick.

Sumchai, whose grandparents came from St. Louis in 1939 and whose father was exposed to asbestos when he worked as a shipping clerk at the shipyard, is an academic success story, emerging from the Sunnydale housing project to graduate from UC San Francisco medical school in 1982.

But while Sumchai is incredibly bright, her eggheadedness sometimes seems to get in the way of letting her make concise, down-to-earth statements. Instead, she often comes across as if she spent too much time in the library, a trait that can leave audiences who don’t have science degrees utterly baffled and uncertain as to what point she just tried to make.

And while the odds are clearly stacked against her in the mayor’s race, Sumchai is using her candidacy to ask tough questions on behalf of a community that is beginning to rally for environmental justice after decades of exposure to pollution from two power plants, two freeways, the shipyard, and a sewage plant that impacts five percent of the city’s population with the smell of treating 80 percent of the city’s solid waste.

"To continue with activities that are harmful challenges the fundamental ethics of being a physician, says Sumchai, who practiced emergency medicine for 20 years.

It’s an experience that informs her current crusade to halt Lennar’s construction on Parcel A at the shipyard. The community’s exposure to dust adds up to "an epidemic," she says.

"It gets on their clothing. It’s airborne. And then there’s the geographic proximity to the site of exposure," Sumchai explains, gesturing to the schools, residences, and neighborhoods that lie downwind of Lennar’s site.

From Monster Park, we take the freeway, exiting at Sunnydale, where Sumchai’s family moved when she was seven.

"When we talk about ‘affordable housing,’ what we really mean is affordable to people making $80,000, while people making $12,000 to $20,000, which is the real average median income in the Bayview, have nowhere to go," Sumchai says. She argues that developers on city-owned land should be required to offer 30 percent to 45 percent of their units at prices affordable to very low-income residents.

Crime is another issue that’s important to the candidate. Sumchai, who used to take the bus from Sunnydale to the Lutheran church on Palau and still uses public transit three times a day, says the gangs she saw then had low-velocity weapons and knives, while today they potentially have access to access military assault weapons.

"The lethality of the gang activity has become enormously problematic," she says, noting that the likelihood of getting enmeshed in the criminal justice system lessens for kids involved in after-school activities more than two times a week.

Sumchai has never lived the posh, comfortable life that is often associated in the public mind with successful physicians. In fact, she’s had to be rescued herself from "critical stressors, major traumas [that] could have led me down a path that was not so productive."

In 1999, she had to surrender her medical license. As California Medical Board records tell it, a series of personal catastrophes hit, and Sumchai was diagnosed with post-traumatic stress disorder after she experienced insomnia, anxiety, emotional upwellings, and re-experienced traumatic moments "when threatened-stressed or exposed to reminders of her graphic experiences as a emergency trauma physician." These upwellings became "explosive outbursts of anger and paranoia" and contributed to Sumchai’s problems, according to her records, which indicate that she received a 116-day stint in county jail, three years’ probation, and a $200 fine for resisting arrest.

Claiming that she did not receive the medical care she needed when she was imprisoned, Sumchai says, "I have as a physician been to the mountaintop and also to the bottom of the pit in terms of my experiences of how the sick, disabled, homeless, and mentally ill are looked upon and treated."

Crediting the influences of key mentors "who had the courage to intervene and bring in resources and moral compasses," Sumchai says her medical license was reinstated in December 2005, but she has no interest or intention of returning to work in emergency or trauma operations. Today she works as a personal trainer, a sports nutrition consultant, and a fitness industry administrator in between writing for the San Francisco Bay View, meditating, doing Pilates exercises, and running for mayor.

And she’s still constantly in fights — even with her friends. Joe O’Donoghue, the fiery former head of the Residential Builders Association, hired her as a personal trainer and told her earlier this year — in confidence, he insisted to us — that former superintendent Matt Gonzalez was getting ready to enter the mayor’s race. The moment she left the gym, Sumchai called Gonzalez — and O’Donoghue promptly fired her.

For now, Sumchai is setting her sights on bringing about change by debating issues that otherwise aren’t being voiced on behalf of folks whose needs and concerns are being neglected.

Isn’t it just great that San Francisco was about to enter into a long-term contract to turn part of our municipal infrastructure over to a company that is laying off 40 percent of its employees, floundering around trying to find a business plan, and getting entirely out of the line of work Mayor Gavin Newsom had in mind?

I feel good that the young mayor (who is acting more and more like a little kid every day) was so careful in preparing plans for a citywide wi-fi service that he never acknowledged, up to the very end, that his public-private partnership was poorly conceived and headed for the rocks.

And now it’s just so special that he wants to blame the Board of Supervisors for scrutinizing the contract — which is exactly what any decent legislative body is supposed to do at a time like this.

The EarthLink nosedive happened at the perfect time for San Francisco. If the company had hung on a little longer to its business plan for citywide wi-fi, the mayor might have managed to push enough supervisors to sign on to the deal. Or his November ballot measure might have passed, and the board might have been afraid to defy the voters. This might have been a grand little fiscal, legal, and political nightmare that could have stalled any progress on municipal broadband for years.

Newsom still insists that he was on the right track. "EarthLink would have been legally obligated to fulfill its promises to San Francisco, and we would have had a functioning wi-fi system by now," Newsom told the San Francisco Chronicle.

But the reality is, a company that doesn’t want to do a job that no longer fits into its business strategy — and a company having enough financial problems that it’s had to cut its staff almost in half — isn’t what you would call an excellent partner. And we can all thank the fact that this Board of Supervisors is relatively independent of the Mayor’s Office for our not being stuck in a rotten deal.

San Francisco doesn’t have a terribly good record of negotiating public-private partnerships or development deals. Back in the early 1980s, then-mayor Dianne Feinstein personally took control of the negotiations with Pacific Gas and Electric Co. for a long-term contract to transmit the city’s power. The deal was about as bad as it could get — everything for PG&E, nothing for the city — but the mayor insisted it was an excellent contract, and she and PG&E’s lobbyists rammed it through a compliant Board of Supervisors. It’s wound up costing San Francisco tens of millions of dollars, and the city’s been trying to get out of it for years. PG&E’s franchise fee is the lowest that any city charges a private utility in California — and it was assigned in perpetuity by a compliant Board of Supervisors in the 1930s.

We’re supposed to be a little more sophisticated today. District elections have ended the mayoral rubber stamp at City Hall, and the mayor should understand that any time he works out a deal like this, the supes are going to give it a hard look. If it’s so great for everyone, then making the details public as early as possible, working with the board (instead of refusing even to show up), and sharpening the deal will make things even better.

That’s not how this mayor does business. And you can tell. *

Where is the love?

OPINION Distant dreams of flowing colored scarves, glowing tie-dyed shirts, and rainbow dashikis commingling with mounds of facial hair and peace signs filled my mind as I walked through a deep recess of quiet green on a hidden trail in Golden Gate Park. It was 7 a.m. I was there to meet Mary X, an OG Summer of Love attendee, as she hastily closed her camp before, as she put it, "the po arrested me and stole all my stuff."

Despite the romantic images of the 1967 events, Mary’s campmates — black, brown, and white houseless elders, several of whom are veterans of the Vietnam War — were barely clothed in soiled flak jackets and torn tie-dyed shirts.

Further shattering the mythos of peace, human love, and community caring, many of these elders sported overlong beards that, unlike those in so many white-ified Jesus pictures, were filled with crumbs and spittle. Their hands were crippled with arthritis and barely able to hold their coffee cups, much less make a peace sign. "I was there," Mary stated plainly, her black eyes searching nervously for the next Department of Public Works truck or park police officer. "I was at the original Summer of Love in 1967." She stopped talking, picked up her backpack, and left without looking back at me.

Mary is a diagnosed schizophrenic, she told me during our original phone call, and like many poor folks in the United States — like my poor mama, Dee, who passed away last year — she has no money for mental health services. Her indigent program allows her a biannual visit with a disaffected psychiatrist who hands her a medication prescription she can’t afford to fill. Her only income is earned from long hours spent collecting cans and redeeming them for small change, very hard work that we at Poor call microbusiness — and a line of work that our magazine, in a recent exposé ("The Corporate Trash Scandal," 8/15/07), discovered is more likely to erase our collective carbon footprint that any corporate recycling company.

While Mayor Gavin Newsom continues with his daily sweeps of homeless people in Golden Gate Park, San Francisco Chronicle columnist C.W. Nevius writes weekly hit pieces that demonize and lie about the poor folks surviving in public spaces, equating them with the wild coyotes that roam the park. Nevius’s hit campaign begs the question for all of us: where is the love?

As thousands celebrate the 40th anniversary of the Summer of Love, how can we criminalize people for the sole act of living without a home and occupying public space? And who should really determine who belongs in open spaces like parks, beaches, streets, and sidewalks?

How have we in the United States come to equate cleanliness with a lack of poor human beings, and how are the people who have come to celebrate the Summer of Love — with their trash, picnic baskets, cars, belongings, and recreational drugs — any cleaner than the homeless folks who live and work in the park year-round and have nowhere else to go?

You’d think that this was a Republican town, with the way the local news media have been bashing not only the left but also some of the better, more effective, and more functional progressive institutions in San Francisco. I wouldn’t waste my time with this stuff, but there are real issues here.

I woke up Aug. 21 to a San Francisco Chronicle headline proclaiming "Anti-gentrification Forces Stymie Housing Development." The piece, by Robert Selna, opened with the sad, sad tale of a poor auto shop owner who wants to "build eight apartments and condominiums on an empty lot next to his Mission District auto shop and rent some of the apartments to his mechanics."

Well, it turns out that the evil Mission Anti-Displacement Coalition is fighting that plan, Selna reported, "insisting that [the] project not go forward until the city evaluates how new development on the city’s east side will affect industrial land, jobs, and housing."

The message: a little entrepreneur is getting hosed by a big, bad "not in my backyard" group that wants to stop new housing. The implication (and this is just the latest example of this stunning lie): the left in San Francisco is against building housing.

Well, for starters, MAC is playing only a modest sideline role in fighting the 736 Valencia project, a five-story structure that is designated legally for condos and includes no affordable housing. The real opposition is a group called Valencia Neighbors for Community Development. The issue, Valencia neighborhood activist Julie Ledbetter said, is that as many as nine new market-rate housing projects are in the pipeline for a short stretch of Valencia, and they shouldn’t be approved one by one without any regard for the cumulative impact.

MAC activist Eric Quezada told me that the organization has indeed taken the position that the city shouldn’t go forward with any more market-rate housing projects until it’s completed a legally mandated environmental study of the cumulative impacts of high-end condos on displacement, blue-collar jobs, and overall land use.

But that doesn’t mean MAC is against housing.

In fact — and this is the killer here — MAC emerged in the dot-com era almost entirely out of the nonprofit housing community. Some of its earliest and most prominent members were (gasp) housing developers. Just for the record, nonprofits have built something like 25,000 low- and moderate-income housing units in this city in the past 25 years. That is housing the city needs, housing that meets the city’s own clearly stated goals. And the progressives, people like the MAC members, are essentially the only ones who have built any affordable housing in the city at all.

Selna told me that he didn’t write the headline and "isn’t taking sides in this." I realize it’s not all his fault that he’s stumbled into a political hornet’s nest — but he has.

Then in the Aug. 22 SF Weekly, Matt Smith wrote that the left is turning this city into nothing but a tourist trap by promoting "a price-goosing apartment shortage of 30,000 to 70,000 units." That’s what, 140 giant new towers, or 7,000 10-unit buildings … that will go where? And what if (as is likely) rents still don’t come down? (Smith had no comment when I called him.)

And now C.W. Nevius of the Chronicle wants to shut down the Haight Ashbury Neighborhood Council Recycling Center so that homeless people won’t have any money … and will what — panhandle more aggressively? Break into cars? Makes perfect sense to me.

The Homeless Youth Alliance (HYA) has quietly operated a drop-in center and needle exchange program in the Haight for the last 10 years. Until last month, very few people besides their clients even knew they existed.

Then the San Francisco Chronicle ran a series of overheated articles about used syringes littering Golden Gate Park. One of the pieces singled out HYA for handing out drug needles "by the double handful."

But the HYA and similar groups have long urged city leaders to deal with needle waste, urging them to install the type of needle collection receptacles used in other cities that share San Francisco’s official "harm reduction" approach to drug use. "We’ve been trying to get disposal boxes [for syringes] into the park for over a year and a half," HYA executive director Mary Howe said.

Yet Mayor Gavin Newsom and his administration have ignored that advice — apparently concerned about its political implications — and have instead ordered police and outreach workers to crack down on the homeless.

"Since the [Chronicle] articles, a few people have decided to stroll in off the street and tell us what they think of us," Howe told the Guardian. "Clearly, they want to think that the syringe problem is on me and on the needle exchange."

But Howe and other public health experts say San Francisco’s 15-year-old needle-swap program has not only dramatically contained HIV, Hepatitis C, and other deadly diseases among IV drug users, it also has actually reduced the number of cast-off needles in public spaces.

Santa Cruz, New York, Baltimore, Vancouver, and many other cities feature disposal boxes in drug hot spots. New York State Department of Health spokesperson Claire Pospisil told us her agency has more than 80 such receptacles around the state. While Newsom has borrowed get-tough programs like community court (for quality-of-life offenses generally committed by the homeless) and some aspects of his Care Not Cash plan from New York, his administration nixed requests to put the boxes in.

Instead, shortly after the first Chronicle articles appeared in late July, the city launched another crackdown on people sleeping in the park, as other mayors before him have done during election years. But several public health and law enforcement professionals told us the raids will never rid the park of addicts looking for a safe place to fix — or the occasional used needle that they leave behind.

"It’s one thing to sweep the park and displace an entire community if you have someplace to put them," Howe argued. "But they don’t have any place to put them."

Howe said her attempts to have syringe containers placed in the park are consistent with the San Francisco Health Commission’s seven-year-old "harm-reduction" mandate, which calls on city health workers and city-funded contractors like needle-exchange programs to minimize, as much as possible, the health dangers associated with drug abuse. Used needles, Howe contends, count as one of these dangers.

But Newsom spokesperson Nathan Ballard confirmed by e-mail that the administration has considered and rejected the idea for now. "The mayor is not eager to put such boxes in the park," Ballard wrote. He added that Newsom has asked the Health Department to consider installing "receptacles … in the right places," but when we asked him in a follow-up e-mail where such "right places" might be, he did not respond.

Rose Dennis at the Recreation and Park Department said that, in the past, the department "floated the idea" of disposal boxes at public meetings. But when it became clear that the containers would not be politically popular, the department quickly gave up on them. "People were really, profoundly opposed to it … and we just didn’t have the confidence that we weren’t going to be vilified for it," Dennis said. "We’re not just going to politically put our asses out there just because someone has an idea."

Several sources in the public health profession lamented this kind of political ass-covering. Dr. Alex Kral, a noted San Francisco epidemiologist, told us, "It’s not that we don’t have solutions to these problems. We have solutions. The problem is the politics…. If you take the politics out of it, we should have syringe disposal boxes in the park and wherever [IV drug users] congregate. At the very least we should have them at the edges of the park."

Even C.W. Nevius, the Chronicle columnist who stirred up the syringe controversy in the first place, supports Howe’s disposal box proposal. "What’s the downside of putting these boxes in?" he told us. "People might think that boxes would somehow encourage people to use drugs in the park, but the reason why [drug users] stay there would not be because there are these boxes."

Nevius added that Newsom called him after his columns came out and "yelled at me for 45 minutes…. He was very upset with the stories and the way they showed what’s happening."

Ballard touted the city’s aggressive new actions to clean up Golden Gate Park. He said that, in addition to the recent raids on homeless encampments, 13 new Rec and Park patrol officers will be dispatched to the park within a month, and "we’re adding additional HOT [homeless outreach] teams to connect more homeless people to the services they need."

Lt. Mary Stasko at the San Francisco Police Department’s Park Station explained how social workers in the HOT teams interact with park squatters during the early morning operations. "The outreach teams go with the police officers and the clean-up crews, and they tell people, ‘We can put you in a bed tonight, we can give you a hot meal right now if you come with us.’

But Stasko was doubtful that sweeps alone will stop homeless drug users from returning to the park. City shelters do not permit substance use, she reasoned, meaning anyone who wants to accept the HOT teams’ offers must choose immediate abstinence. "For the people who are interested in quitting, [the city’s new outreach efforts] are working like a charm. But then you have the hard-core people who don’t want to stop using. They’re the ones who end up coming back. Those are the types that have been in the park since 1967."

Canadian epidemiologist Dr. Evan Wood cited San Francisco’s "high-threshold," abstinence-only approach to services as a major factor in Golden Gate Park’s chronic cycle of homelessness and substance abuse. He has been involved with implementing Vancouver’s successful "safe injection site," where people can safely shoot up and dispose of their needles. Similar facilities are already widespread in Europe.

"Trying to simply eliminate these behaviors does not work," Wood went on. "You have to meet these people on their turf."

The death of Polk Street

Kelly Michaels was following the San Francisco dream when she escaped her small Alabama hometown at 17 and hitchhiked westward. It was 1989.

"I had stars in my eyes," Michaels told the Guardian, sitting on the floor of her friend’s small single-room occupancy Tenderloin apartment, hints of a Southern drawl now paired with Tammy Faye mascara and bleached-blonde hair. "When you’re 16 or 17 and have dreams of being famous, you come to California — and you probably end up on Polk Street in drag."

Michaels arrived on Polk with little more than blue jeans, a bra, and rubber falsies to her name, making ends meet as a street sex worker. It wasn’t what she was looking for; the Polk was plagued with drugs and violence. But her dad was embarrassed by his transgendered daughter and didn’t her want her back. The neighborhood was a home.

She found a community at fierce Polk Gulch trans and boy-hustler bars like Q.T. and Reflections, where clientele included one "big, tall, black Egyptian transsexual hell-raiser" known to draw a gun. Scores of boy hustlers "coming in daily from the Greyhound station" danced naked on the bars. At the end of the night, Michaels’s new family members would pool their money and rent a hotel room for $30.

"The bars were the churches, the sanctuaries," Michaels’s friend Terri, an African American man in his 50s, told us. "You weren’t really going to be hassled there."

Not any more. "Polk Street is dead," Michaels told us. "Dead as fuck now."

THE NEW POLK STREET


The new kids on the block are calling it "revitalization."

After the three-decades-old gay bar Kimo’s is transferred to a new owner at the end of September, there will be only two queer bars left on a street that was San Francisco’s gay male center in the 1960s and a gritty, affordable home for low-income queers, trans women, and male sex workers in the following decades. Where scores of hustlers lined up against seedy sex shops and gay bars just a few years ago, crowds of twentysomething Marina look-alikes now clog the sidewalks in front of upscale clubs.

Polk’s queer residents and patrons are now being priced and policed out of their neighborhood — and their city — as business and tourism interests continue to eat away at the city’s center. Lower Polk Gulch, just blocks north of City Hall and one block east of Van Ness, has in the past few years succumbed to multimillion-dollar businesses, upscale lofts, increased rents at SRO hotels and apartments, and a new million-dollar city streetscape beautification plan. The related increase in policing and new efforts to clean up the street is making the area an unwelcoming place for the marginal queers who for so long called it home.

It has been the most down-and-out segments of the queer population — male sex workers, trannies, young people, poor people of color, and immigrants — who have often been the queer population’s boldest and most innovative actors, pushing the movement forward in new ways. What does queer San Francisco lose when our most marginalized members are pushed, policed, and priced out of the city?

HEART OF A COMMUNITY


Michaels stood under a neon purple Divas sign, advertising the three-story transgender club that has stood in Polk Gulch for more than three decades. Divas manager Alexis Miranda, a friend, stepped outside to chat, and a dozen characters from the neighborhood stopped by to shoot the shit. One man rubbed Miranda’s belly through her leopard bodysuit. "This is my baby," he told us jokingly.

Divas is as much a community center as it is a club. Girls from out of town and out of the country know to come to Divas when they step off the boat, plane, or bus. Many trans immigrants make a living as prostitutes, and while Miranda insists that she does not allow them to work inside the club, the close vicinity of San Francisco’s tranny prostitute district has meant tension for Divas.

Miranda told us the police have been targeting the club because of complaints from new merchants. "Some of the people who have new businesses don’t want the people who live here to stay. They want to close us down," she said. "They’re trying to gentrify the neighborhood."

Neville Gittens, a police spokesperson, told us that the San Francisco Police Department performs "regular enforcement in that area" but said any targeted operations cannot be discussed.

Theresa Sparks, a trans woman who chairs the Police Commission, said Miranda made the same claim at the commission meeting Aug. 15. "I don’t know if that’s true or not," Sparks told us. "My intent is to find out what is going on."

Sparks agreed that gentrification is driving trans people out of the Polk Gulch neighborhood: "It is very, very difficult for a transgendered person to survive in this city."

Miranda pointed to a bar across the street. Until 2000, the Lush Lounge was the cruisy trans and hustler bar Polk Gulch Saloon. Now, under a new owner, white twentysomething heterosexuals sip apple pie martinis.

Sonia Khanna, a 28-year-old trans woman with long, curly brown hair and mocha skin told us she doesn’t feel welcome there. "If you’re a tranny, they think you’re a whore," she said.

Miranda said the owner, Steve Black, ejected her when she went to welcome him to the neighborhood. Miranda, a former empress in San Francisco’s Imperial Court System, reported him to the Human Rights Commission. The inquiry was closed when the owner informed the commission that he allows transgendered people into the bar. He didn’t deny tossing out Miranda; he said he just disliked her personally.

The bigger problem may be the neighborhood’s increased property values. Divas owner and Polk Gulch resident Steve Berkey told us that rents have pushed out other established queer businesses on Polk. The only reason Divas stays open is that he owns the building. "It used to be that so many girls lived in the neighborhood," he said. "They packed the place. But now rents have driven them off."

CENTER OF THE STORM


The reasons behind the death of the queer Polk are complex, likely including the ascendance of the Internet as a social networking tool, rising property costs, and the aging of the bars’ core clientele and owners. But most of the community’s rancor has focused on the most visible manifestation of change: neighborhood associations representing new, upscale businesses working with police and the city to clean up the streets.

At the center of the storm is a glass-walled architecture studio at the bottom of Polk Gulch, around the corner from Divas. Two freshly planted palm trees in front of the studio are conspicuous on a site next door to a bleak, institutional homeless shelter outfitted with security cameras and across the street from a porn shop promising "Hot Bareback Action!"

Case+Abst Architects has been the workplace and home of husband and wife Carolyn Abst and Ron Case since they were lured by the area’s low cost in 1999. The trees were the first of 40 planted in a campaign they initiated last year as cofounders of Lower Polk Neighbors. Abst told the San Francisco Chronicle in September 2005 that she "wants a fruit stand [on Polk Street], and we’ll take a Starbucks too."

The group has had an impact: District Attorney Kamala Harris said at a recent community meeting organized by the LPN that she has responded to association agitation by having representatives of the District Attorney’s Office walk the neighborhood with police and installing high-tech surveillance equipment to gain more criminal convictions. Sup. Aaron Peskin has asked the Mayor’s Office of Economic and Workforce Development to include the Lower Polk in its Neighborhood Marketplace Initiative, a program designed to revitalize neighborhood business districts. As part of this program, a part-time staff person now acts as a liaison between Lower Polk merchants and police. Another city program is scheduled to spend $1 million on installing new lights and planting trees later this year.

Activists say the LPN focus is not on outreach, therapy, or support for the Polk’s marginalized residents but on pushing undesirables out of the neighborhood and ejecting outreach programs like a local needle exchange.

Last year Abst was the subject of a "wanted" poster put up on Polk by the group Gay Shame. The group calls the LPN a "progentrification attack squad" whose goal is to "remove outsider queers and social deviants from our neighborhood in order to accelerate property development and real estate profiteering."

The hustler bar Club RendezVous lost its lease in 2005 after the property was bought and razed. Its co-owner, David Kapp, didn’t return our phone calls seeking comment, but he told the Central City Extra in February 2006 that a "smear campaign" by the LPN stopped him from relocating down the street. A First Congregational Church is now being constructed where RendezVous once stood. The church was designed by Case+Abst.

Case told us that the Planning Department wanted to see neighborhood support for the RendezVous move. The LPN asked that RendezVous provide security, but the bar’s owners refused. "They always had younger, underage boys hanging out," Case said. "There are a lot of families in this neighborhood. We wished them well, but it’s also a community." He told us he wants not to gentrify the neighborhood but to make it clean and safe.

But safe for whom?

Chris Roebuck, a medical anthropologist at UC Berkeley, told us that the increased policing has also meant increased harassment of trans women. Sex workers, many of them immigrants from Mexico, the Philippines, and Thailand, are "increasingly being pushed into the alleyways, into unsafe spaces," he said. He’s also noticed a criminalization of what he called "walking while trans" in the six years he has spent interviewing trans women on Polk Street.

At a community meeting with the district attorney earlier this month, two trans women said the police, despite sensitivity trainings, do not take them seriously when they report a crime.

"Getting rid of the public space for trans women and drug users is not safe for them," Polk resident Matt Bernstein Sycamore (a.k.a. Mattilda) told us. "Deportation [of immigrant sex workers] is not a safe space. The needle exchange actually does make people safer. Getting rid of it does not make people safer."

Sycamore, editor of the book Tricks and Treats: Sex Workers Write About Their Clients, is concerned with what he calls a "cultural erasure" in the area. "Polk Street has been the last remaining place where marginalized queers can come to figure out how to cope, meet one another, and form social networks," he told us. "That sort of outsider culture has been so dependent on having a public space to figure out ways to survive. That is the dream of San Francisco — that you can get away from where you came from and cope, and create something dangerous and desperate and explosive."

POLK VILLAGE?


When Kimo’s changes hands at the end of September, San Francisco will lose one of the last vestiges of a hustler culture housed on Polk Street since at least the early 1960s.

On a recent night, six gray-haired men sat chatting or reading the paper, relics of Polk Street’s heyday. A young man with a shaved head and black hoodie stood outside the front door and gave a suspicious look to a young blonde woman in bikini straps who breezed in with two friends, laughing, oblivious to him. A sign in front read "No Loitering In Front of These Premises."

The state’s Department of Alcohol Beverage Control mandated the warning, Kimo’s bartender John David told us. He said he thinks that was the result of pressure from the LPN. "Kimo’s is the new whipping boy," he told us. "RendezVous is out, and now it’s our fault that people are on the streets."

Case denies that his group had anything to do with the crackdown on Kimo’s.

A tall man with shaggy brown hair standing on the sidewalk near Kimo’s, who asked to be identified by his porn-actor name, Eric Manchester, complained that a way of life is coming to an end. Manchester said he started hustling on Polk at age 17 after leaving the "redneck, racist town" of Martinsville, Ind., in 10th grade and being stationed in San Diego by the Navy.

"It wasn’t just money for me," Manchester told us. "This was a good place to come and get advice, comfort, support. There are people that need people, and they’re going to take that all away. San Francisco is going down the tubes. All the heterosexual people are moving in. They like the police-state mentality."

Among the new arrivals is the owner of the $6.5 million O’Reilly’s Holy Grail Restaurant that stands just a few doors down Polk Street from Kimo’s. On a recent evening, a musician played soft jazz on a black grand piano, while men in starched pastel button-down shirts stood around on the hickory pecan floor.

Myles O’Reilly opened the restaurant two years ago, when he also transformed a low-rent residential hotel above the space into 14 European-style hotel suites. Neighbors point to the property as a tipping point in Polk’s transformation. But O’Reilly sounded almost defeated when he talked about his "multimillion-dollar jewel in the middle of the desert."

"We are only a couple blocks from City Hall and Union Square," he told us. "But tourism doesn’t come this way."

With the goal of transforming the area, he teamed up with John Malloy, the head of the recently founded Polk Corridor Business Association, who has also chaired the LPN.

One of their projects is on view outside the restaurant and along the street. Colorful banners read: "Welcome to Polk Village … working together to build a cleaner, safer, more beautiful community." The PCBA plans to circulate a petition to officially change the name of Polk Gulch to Polk Village in a few years, but O’Reilly isn’t waiting. He defiantly lists the restaurant’s address as 1233 Polk Village on his building.

That "village" will house a small army if these merchants have their way. "We need foot patrols up and down Polk Street," Malloy, who lives in the neighborhood, told us. "We’re going to get more police even if we have to go out there and hire them ourselves."

O’Reilly took out his cell phone and started showing me photos. "This is defecation on the sidewalk outside," he said, pointing to a smudgy image. "This is condoms on the sidewalk. You see this lovely photograph? That’s a condom in the flowerbed. That’s what my son had to see this morning. And nobody helps."

"There are 1,000 condos being built here," O’Reilly said. "Something has to be done to restrict the number of street people."

VANISHING NEIGHBORHOODS


The Tenderloin, and to a lesser extent Polk Gulch, risked being swallowed by the expanding downtown financial district and tourist industries in the late 1970s. But in the 1980s, community activism secured a moratorium on the conversion of residential hotel units, required luxury hoteliers to contribute millions of dollars in community mitigations, downzoned dozens of blocks of prime downtown property, and created a nonprofit housing boom.

It is these achievements that new merchants and residents point to when distancing themselves from the word gentrification. LPN cofounder Case told us that because apartments in the area are rent controlled, gentrification is "not possible."

Not so, said Tommi Avicolli Mecca of the Housing Rights Committee. "Look at the Castro," he told us. "It’s full of rent-controlled buildings. All you have to do is evoke the Ellis Act, or you buy out the tenants."

Or look next to the Congregational Church construction on Polk. There stands an almost-completed four-story building whose 32 units are being sold for up to $630,000. A large glossy poster in its window advertises the units’ "open living and dining areas," along with "stainless steel appliances, custom cabinets, [and] granite counters."

Brian Bassinger, cofounder of the AIDS Housing Alliance, told us that in one of the buildings where his organization houses people a few blocks south of Polk Gulch, rent is now $1,700 a month, up from $1,325 just a few years ago.

Gayle Rubin, a professor of anthropology at the University of Michigan and a historian of South of Market leather cultures, told us that gay neighborhoods are disappearing across the country as the core of major cities are transformed into high-value areas. This puts pressure on the economic viability of queer neighborhoods, most of which — despite the stereotype of the wealthy gay — have taken root in marginalized, poor neighborhoods.

"Polk Street is just one little battle in the war," Mecca told us. "The Mission was a working-class lesbian area. That whole lesbian culture got lost overnight. The bustling culture of queer artists in the Castro — all gone. The South of Market leather scene — gone. Parts of our culture, the very thing we came to San Francisco for, keep getting wiped out."

Kelly Michaels did develop a certain amount of celebrity as a performer at the famed club Finocchio’s and as a porn star; fans still post photos and gush over her online. And she remains drawn to the Polk, even if her relationship with the neighborhood is deeply ambivalent.

"It’s so evil, so dark, full of drugs and despair," she told us outside Divas. "But this is my home and my family."

"The people left here are going to fight for their home," she said. "Some people have been here forever. Their whole life is here. It’s impossible to get an apartment in other places of this city."

"This is a sanctuary," she said. "They’re taking the sparkle out of San Francisco."

Now recycling is the problem

The latest installment in the San Francisco Chronicle’s war on the homeless is pretty insane. According to C.W. Nevius, the Haight Ashbury Neighborhood Council’s recycling station is part of the problem and perhaps ought to be shut down.

Think about this for a second: Homeless people have had their general assistance and SSI benefits cut repeatedly. G.A., thanks to Care not Cash, is down to almost nothing. So how are these folks supposed to eat (much less ever find a place to live)?

Some of them do a bit of real work: They go around town and collect bottles and cans, some of which would otherwise be unsightly garbage. Some of the cans and bottles also came out of people’s blue bins, and would otherwise by recycled (for money) by the private garbage company, which is quite profitable anyway; I’m not going to cry about that sort of “theft.”

So these folks haul the bottles to the recycling center and get a few bucks, which, as the Chron even admits, often goes immediately for (imagine this!) food. I bet some of the remaining money sometimes goes for booze or drugs. (Some of my remaiming money every week goes for booze, too, and I know a few highly upstanding citizens who spend some of their disposable cash on the ol’ Evil Weed. I don’t think this signals the imminent decline of society.)

Here’s my question: What would the opponents of the HANC recycling center do — deny the can-collectors their money? Because here’s what would happen: More aggressive panhandling. More petty theft. Car windows broken and stereos stolen. Bicycles stolen. That sort of thing.

As long as we can’t provide people with a decent place to live in this rich city, some will sleep outdoors, including in the park. And they’re going to find a way to get some cash every day. I think the current situation is a lot better than many of the available alternatives.

Chronicle hits Burning Man…badly

The San Francisco Chronicle leads the Sunday paper with a hit piece on Burning Man, wrapping several disparate points under the implied thesis that there is financial corruption in the organization. But the journalism and logic employed by writer Justin Berton and his editor is so bad and misleading that it says more about the Chronicle than Burning Man.
The most egregious example is the pull quote that leads the full-page jump: “This is not a financially healthy organization. If I were a donor, I’d think long and hard before I sent money their way,” Sandra Muniutti, Charity Navigator analyst.
It sounds as if she’s talking about Black Rock City LLC, which stages the event, rather than the event’s nonprofit wing, Black Rock Arts Foundation, which she analyzed. (Full disclosure: my girlfriend Alix Rosenthal is on the BRAF advisory board, although most of my knowledge on this issue comes from years of reporting work I did for the Guardian and my own attendance at Burning Man).
It’s classic bait-and-switch journalism, conflating two organizations to make a point. It’s also bad journalism because it lacks context on why BRAF gave just 27 percent of their revenue to artists. Here’s the context: most of BRAF’s work has been to place artwork that already been built — in most cases with art grants from BRC — around San Francisco, a task at which BRAF has been more successful in recent years than any group in town.
But the Chronicle, by dishonest implication, would have you believe just the opposite is true.

Oppose Don Fisher’s museum

EDITORIAL Not long after the US Army announced it no longer needed the Presidio for a military base, a group of powerful San Francisco business leaders began eyeing what would become the first privatized national park in America. Among the businesses aiming to grab a piece of the immensely valuable real estate were Pacific Gas and Electric Co. and Transamerica Corp.; among the individuals was the founder of the Gap, a Republican named Don Fisher.

Fisher helped then–US representative Nancy Pelosi pull off an astonishing feat: she took more than 1,200 acres of land earmarked by federal law as a national park and handed it over to real estate developers (see "Stolen Base," 5/8/96). Fisher, who became one of the first members of the private board that manages the Presidio, was around to help George Lucas build a massive business park on the site — and pick up a $60 million tax break in the process.

Now Fisher, who along with his billions has amassed a pretty impressive collection of contemporary art, wants to build a gigantic private museum right in the heart of the park, at the site of the old post. His plan would drop a 100,000-square-foot Battlestar Galactica on the old parade grounds, wiping out a sizable amount of open space. The museum would be on public land, but he’d run it himself, in his own way, with no public oversight.

This is a terrible idea, and San Franciscans ought to be up in arms about it.

According to reports in the San Francisco Chronicle, Fisher has been looking for some time for a way to display his art collection, and he has talked to people at the existing big museums, the Museum of Modern Art and the de Young. But those talks broke down — in part, we’re told by sources, because Fisher didn’t want the professional curators and museum directors calling any shots. He wanted complete control over the art — control over where it was hung, when it was displayed, who got to see it, etc. The folks who run those cultural institutions are too polite to say so in public, but they don’t generally go for that sort of demand. So Fisher did what billionaires around the country are starting to do: he decided to build his own museum.

That’s his right, of course, and if he’d sought a spot, say, South of Market near SFMOMA, it might not be a bad thing. But the Presidio is entirely the wrong place for this sort of institution.

For starters, there’s no easy way to get there. Transit to the main post at the Presidio is very limited — one Muni line, which runs infrequently. No BART, no light rail — nothing of the sort of access you would want for a major public attraction. Car access is through the crowded Marina neighborhood, and the museum would no doubt build a huge parking garage, meaning the park and the surrounding areas would be inundated with cars. That alone would be a violation of the spirit of all the nation’s parks, which are trying desperately to reduce the number of car visits. There are no other cultural attractions around, so visitor traffic to Fisher’s museum would have no spillover benefits for any other museums.

And he’s talking about a whopper of a structure. There’s no way to gently insert a building that big into the park; it can’t blend in with the existing structures or the natural scenery. It’s just going to stick out like a bloated, gangrenous sore thumb, ruining the view and the historical nature of the area.

The private Presidio Trust has sole discretion over the proposal, but city officials can speak up, loudly. The Board of Supervisors should pass a resolution opposing the museum, the arts community should demand that it be relocated, and the public at large ought to tell the trust and Fisher that his personal memorial edifice isn’t welcome in the park.*

Is Bruce Brugmann alive, or is he spinning in his grave?

Several folks pointed out to me that the San Francisco Chronicle carried a premature comment on my death, in its Aug. 9th feature “What people say about the designs (of our new towering highrise buildings).”

It quoted Michael S. McGill, the former executive director of the San Francisco Urban Planning & Research Association and former executive director of the Bay Area Forum, 64, now living in Washington, D.C.

Said Gill, “Having left SF at the end of the two-decade war over high-rises, in the early ’90s, I am astonished at the apparent public support for ‘the tallest high-rise on the West Coast.’ How things have changed! Is (San Francisco Bay Guardian publisher) Bruce Brugmann still alive, or is he spinning in his grave?”

Hey, Mike, good to hear from you. Your report of my death is premature and I am happy to report that the Guardian
is still firmly on top of the highrise issue, which I like to call pellmell Manhattanization. We stopped the first highrise boom with Proposition M, the limited growth initiative on commercial highrises and the downtown highrise boom.
But now the issue is highrises with million-dollar condos, ugly, much too high and out of proportion for a compact city and its compact neighborhoods, built not for residents but for people working outside the city and driving out our lower income and middle classes.

You can rest assured, Mike, that we are on the story and fighting them every way we can. And soon you may see the equivalent of a Prop M for highrise condos. Can we count on you to come back and join the battle?

Postscript: “The Devil’s Bargain at the Transbay Terminal,” a blog by Guardian Executive Editor Tim Redmond, eloquently summarizes the key political point behind the new highrise boom. “Nobody in California wants to pay higher taxes for anything. So the folks at City Hall have decided that the only way we can have a new transit terminal is if we hock a piece of our city and our skyline to fund it. So we take some of the land on the terminal site and let a developer build monstrosity of a highrise on it–and that will bring in the money that we can’t get any other way.”

Day’s dilemma

One investigation by the District Attorney’s Office is enough of a headache for City College of San Francisco. But two?

The Guardian learned that just days before the November 2005 election, in which City College asked voters for $246.3 million in bond money to continue a series of capital works projects, the office of Vice Chancellor Peter Goldstein received a letter from investigators requesting detailed information about a land transaction that took place in Chinatown earlier that year.

At least three of the school’s elected trustees don’t recall being informed by Chancellor Phil Day about the probe, setting off new concerns after we alerted officials about the letter, which the Guardian obtained. The DA’s Office is also investigating potential laundering of public funds into campaign donations by college officials in connection with that bond campaign.

"It puts a further cloud on the college," trustee Julio Ramos told us. "Presumably the statute of limitations has not run on the transaction, so what’s going on here? I’m concerned because no one ever informed us."

Two other trustees, Milton Marks and board president Anita Grier, told us they don’t remember being told of the inquest.

"We do have to give them some leeway to operate the college without informing us of everything," Marks said. "But when the district attorney is asking questions about something that’s coming from a board action, why wouldn’t we have to know about it as early as possible? It’s kind of indefensible."

But Day fervently insisted that the board was informed of the letter during a closed-session meeting the same month the letter was received and that Ramos and Marks simply weren’t there. Day had no explanation for why Grier couldn’t recall it, but trustees Rodel Rodis, Natalie Berg, and Lawrence Wong and former trustee Johnnie Carter all confirmed they’d been told about it. Day also said the school had never heard back from the DA’s office after it produced all of the requested documents.

"I had even forgot about the fact that we had this initial inquiry back then," Day told us. "I had totally removed it from my brain and forgotten about it completely."

Either way, this is the first the public has heard of the DA’s interest in City College’s land deals. Debbie Mesloh, a spokesperson for District Attorney Kamala Harris, told us she could neither confirm nor deny that any such investigation was taking place, although the letter confirms that an investigation was opened.

The DA this year began an inquiry into City College after the San Francisco Chronicle revealed that the school had used a $10,000 lease payment from a business tenant to help bankroll a campaign committee formed for the purpose of promoting the 2005 bond election, City College’s third since 1997.

But we now know that the DA began snooping around the college’s land purchases in October 2005, when Goldstein was asked for escrow documents, property appraisals, memos, and board minutes concerning the school’s purchase of two lots in Chinatown at the corner of Kearny and Washington streets for a long-planned (and now vastly over budget) campus.

The Guardian has also obtained a pile of documents detailing months of real estate negotiations between the college and politically connected Chinatown businessman Pius Lee, who owned one of the lots and had an option to buy a neighboring and much larger tract.

The construction of the new Chinatown–<\d>North Beach campus hasn’t gone smoothly for the college or voters. The school originally used $5.8 million to buy property in the neighborhood using bond money that voters authorized in 1997. Voters were then asked for $45 million in 2001 to build the campus, with construction expected to begin in 2003.

But Day’s ambitions led to clashes with Chinatown residents after the original plan — slated for an area facing Columbus Avenue on the other side of the block from where City College now hopes to build — called for demolishing a historic building and low-income apartments housing elderly tenants.

The school entered a legal settlement promising to preserve the Columbo Building and relocate the nearby Fong Building’s tenants. In 2005, however, it hastily decided incorporating that work would be "infeasible" and turned to Lee for help in finding a new location.

Lee (who did not return our calls) told the college he’d give up a sliver of land he owned on the other side of the block and also help it secure the much larger lot nearby owned by a Taiwanese company, Fantec Development Corp., with which Lee had a long business relationship.

The school paid Lee $1.9 million for a strip of parking lot 18 feet wide, even though an appraisal that City College received placed its market value at $1.1 million, records show. (San Francisco County assessed it at $267,000 in 2004 for tax purposes. The neighboring, much larger piece of land, also a parking lot, was assessed at $1.5 million.) During early negotiations, records show, the college offered $785,000 for Lee’s property and $4.5 million for Fantec’s, but in the end it wound up paying much more — a total of $8.7 million in bond money for both.

Yet it’s not clear precisely what investigators were looking into, what they found, or whether the investigation is still open.

"The properties were not available for anything less than the price we paid for them," Goldstein told us. "That’s what the sellers demanded in order to sell their properties…. Pius drove a very hard deal and demanded what I would consider to be the maximum possible price for his property that we could defend."

Ground still hasn’t been broken on the school’s Chinatown dream, and in the interim, as we’ve reported recently, the estimated costs have ballooned from $75 million to $122 million, an increase of 62 percent. As a result, the school has chosen to gut some projects authorized by voters to keep this and other favored proposals alive (see "The City College Shell Game," 7/4/07).

Harm reduction in the park

OPINION Mayor Gavin Newsom’s moves to sweep homeless people out of Golden Gate Park have generated a lot of controversy — and a lot of people are missing the point.

I’m not so concerned about people sleeping in the park, just as I’m not so concerned about people sleeping on the sidewalks or the streets if there is no other place available, so long as they are just sleeping.

If folks just slept in the park, cleaned up after themselves, and moved on during the day, most of us would probably not notice. If my friends and I decided to take our tents and sleeping bags to the park and spend the night, there probably wouldn’t be any trace of our stay the next day.

My main concern is when ancillary conduct related to a poverty existence, such as defecation, urination, and the dispersal of syringes, becomes problematic. Is it worse when these things happen in Golden Gate Park or Corona Heights than it is when the same behavior occurs around Marshall Elementary in the middle of the Mission? The costs to police the park and the concrete public realm to the extent that one would see a difference in less feces and fewer syringes are probably as significant as the cost of constructing facilities to house and treat the homeless.

A feasible midrange political solution would be to adopt a broad front of harm-reduction policies designed to lighten the annoying footprints of the homeless on our public spaces without attacking them as human beings. Many are seriously messed up for an often overlapping variety of reasons. Outreach workers, instead of forcing homeless people through the criminal justice system, should offer appropriate technology disposal solutions for the most dangerous waste and trash as well as services to help with sanitation. I’d like for the city to initiate a "shit in a bag" program under which city workers would communicate to the homeless the importance of not befouling public space and provide plastic bags, toilet paper, and sanitizers for them to use.

Similarly, syringe-disposal systems are inherently safe, are designed to be unopenable without tools, and should be deployed in sites frequented by injection drug users.

It should be noted that nobody is noticing any more of these annoyances now than they were five years ago. The San Francisco Chronicle is simply tossing Newsom a softball for his reelection campaign so that he can appear tough on crime for his base voters (as if that is going to be an issue this year). It’s not cost-effective to deploy the San Francisco police to deal with homelessness. It’s also not cost-effective for the city to make up for the abdication by the state and federal governments of their responsibility to deal with the mentally ill and drug abusers.

So we can either complain or attempt another approach.<\!s>*

And so the headline in the new Editor & Publisher magazine proclaims, “Bronstein Launches New ‘Journalism of Action’ After Big Cuts.” And the lead says that “With its massive newsroom staff cuts essentially complete, the San Francisco Chronicle is embarking on a new approach to coverage that Editor Phil Bronstein likens to that practiced by William Randolph Hearst.”

Impertinent questions for Bronstein and Hearst corporate: Does “journalism of action” mean you will you now start covering the PG&E/City Hall/Raker Act scandal stories? If not, why not? And if not, could you explain which Hearst “journalism of action” tradition you are talking about? Are you talking about the anti-PG&E “journalism of action” tradition in which Hearst supported the federal Raker Act that allowed San Francisco to dam the Hetch Hetchy dam in Yosemite National Park for the city’s cheap, public water and power supply? Or are you talking about the pro-PG&E “journalism of action” tradition in which Hearst reversed himself in the late 1920s to support PG&E and oppose public power after getting a handy chunk of capital from a PG&E-controlled bank?

Let me put the question as simply as I can: Does the
new Bronstein policy mean that Hearst will end its longtime “journalism of action” on behalf of PG&E and start some “journalism of action” on behalf of San Francisco residents and businesses? Let us pray.

The ugly news we’ve been waiting to hear

Alas. Alas. As predicted by the Guardian, the Bruce blog, and most everybody in and around the Dean Singleton news operations, the bad news was flashed this morning by my reliable source in Contra Costa County in his note and Singleton story below.

This was a major story on yet more news consolidation in the Bay Area, but it only rated a three paragraph burial story on page 2 of the daily digest page of the business section of Singleton’s only Bay Area daily “competitor,” the San Francisco Chronicle.

Its lively head says, “Chain consolidates newsroom operations,” which means in effect “please don’t read this story, it is damn boring.” Its boiler plate press release coverage says without blushing: “The consolidation of the papers, all owned by MediaNews Group (B3: Singleton) will result in job cuts as part of an effort to eliminate redundant positions, beef up online coverage and save money…The company said that it hopes attribution will cover the staff reductions, but added that layoffs may be necessary…Local news reporting will continue to be supervised by editors at each of the newspapers…” Wow, now that is real enterprise business reporting!

My source wrote by email:

“The following appears today in the business pages of at least the CCTimes and Oakland Trib. Times ran it below fold on pg. 1 of business section; Trib ran on an inside business page.

“I still have the image of Singleton standing in the city room of the Times at the time of the sale, saying staff and editorial direction for the various papers would remain in place. Hah. It won’t be long before there is but one newspaper to serve the East Bay, perhaps with zoned editions that are community specific.” (B3: my source, a veteran newsman who has lived in the county for years, has yet to be wrong on any of his predictions.)

East Bay newspapers plan to consolidate news operations
Owner of Times says move will improve coverage, efficiency

The company that owns the Times said it will consolidate the news operations of several East Bay newspapers as a way to improve coverage of the region and create a more efficient organization.
Starting Aug. 13, all employees of the East Bay papers affected will work under the umbrella of Bay Area News Group-East Bay, said John Armstrong, vice president of California Newspapers Partnership, which owns the publications.
“We are making this change, which integrates three entities into a single operation, to allow us to maximize our East Bay news-gathering capabilities,” said Armstrong, publisher of the Times.
The daily newspapers affected by the consolidation are the Contra Costa Times, Oakland Tribune, Tri-Valley Herald, Valley Times, San Ramon Valley Times, East County Times, West County Times, Hayward Daily Review, San Joaquin Herald, Fremont Argus and San Mateo County Times. A number of nondaily papers are also included.
The reorganization will “eliminate wasteful redundancies, streamline management and redirect staff and resources to our interactive services and other priorities, such as watchdog journalism,” Armstrong said in a memo he sent to employees of the newspapers.
Job cuts could materialize as a result of the consolidation.
“As we eliminate duplication of effort in our newsrooms, we will reduce the size of the editorial staff,” Armstrong stated. “It is our hope attrition will cover this reduction, but there is no guarantee that layoffs can be avoided.”
The combined newsrooms now have about 360 employees, said Kevin Keane, executive editor of the Times and vice president for news of the regional news group. Keane will become executive editor of Bay Area News Group-East Bay. Pete Wevurski, who had been editor of ANG Newspapers, will become managing editor of the new editorial organization, reporting to Keane.
The changes come as newspapers nationwide must wrestle with defections of advertisers and readers to the Internet.
“We need to start thinking of ourselves as information companies and not just as newspaper companies,” Keane said.
He said he believes the emerging news organization in the East Bay can deploy reporters and other news employees in a way to help the newspapers embrace a fast-changing digital world.
“We can put content online virtually 24 hours a day, seven days a week,” Keane said. “We can break news online around the clock.”
Although the restructuring of the news industry has brought about painful changes and may continue to do so, Keane suggested the changes also can bring plenty of upside.
“There are a lot of challenges in the newspaper business with advertising drifting away to the Internet,” Keane said. “There is also a lot of opportunity to do things in new ways. The challenge for us is to find a balance between our reader demands for online content with our core print business.”

Watchdog journalism? C’mon. For starters, the Singleton papers will be covering even fewer night meetings of the local city councils, planning commissions, school and community college boards, and other government agencies in the East Bay and Singletonland. And they sure as hell won’t be covering the news or selling ads in a competitive newspaper environment. Alas. Alas. B3, ever more annoyed to find that newspapers, even as monopolies, continue to do such a lousy job of covering the biggest local story on their turf (themselves)

Months after local videographer and blogger Josh Wolf was released from federal prison — where his seven-month stay was the longest in history for an American journalist for refusing to turn over unpublished materials to criminal prosecutors — the San Francisco Police Commission finally has decided to analyze the incident. That inquiry comes just as Wolf embarks on a campaign for mayor, which he hopes will create a dialogue about the lack of police accountability and the overzealous federal intrusions that marked his story.

Wolf, 24, told the Guardian that he’s still baffled by what transpired after he filmed the July 8, 2005, anti-G8 protest, which involved a heavy anarchist turnout, "got rowdier than local officials would have liked," and left a San Francisco police officer with a fractured skull — an incident that Wolf calls "unfortunate" but of which he claims to have absolutely no knowledge

"I’ve read the evidence that was presented in my case, but to this day no one has pointed out anything that constitutes terrorism," Wolf said.

The day after the protest, Wolf was contacted at his home by members of the FBI and the Joint Terrorism Task Force, along with two San Francisco Police Department officers. The four agents who showed up Wolf’s door, one of them dressed in a Hawaiian shirt and shorts, demanded that he hand over all his video outtakes after local and national TV stations aired edited footage that Wolf posted on his blog. The aired film included scenes of anarchists setting off firecrackers, turning over newspaper racks, and spray-painting a Pacific Gas and Electric Co. office. It also showed an SFPD officer holding local resident Gabe Meyers in a choke hold while another agent waved his weapon at the crowd and shouted, "Leave or you’re going to get blasted. I’m a fed, motherfucker."

"If any time the SFPD decides it doesn’t want to deal with some local issue, does it have the autonomy to contact the feds, and if so, doesn’t that jeopardize all the laws that the voters of San Francisco have passed?" Wolf asked July 11 as the Police Commission discussed a resolution supporting the First Amendment rights of the "new media," which is how Web-based disseminators of news, such as Wolf, are being described.

Earlier this year, police commissioner David Campos tried to pass a resolution in support of the then-jailed Wolf, but the proposal got no traction until Theresa Sparks was elected as president in May. By then Wolf had been free from jail for a month, leading Campos and Sparks to shift their focus toward investigating exactly why Wolf’s case got federalized in the first place as well as the implications for other groups that are protected locally but at risk federally.

As Campos told the commission, "A lot of people in San Francisco have been talking about how we as a department interact with the feds, to the extent that it has an impact on medical cannabis providers and immigrants and on First Amendment rights, as in the case of Josh Wolf."

Under state law, reporters’ sources and their work products are protected. A recent case involving Apple suggests that the law also extends to bloggers and independent reporters. But under federal law, reporters have no such protections, which is why former New York Times journalist Judith Miller was jailed in the Valerie Plame–CIA investigation and San Francisco Chronicle reporters Lance Williams and Mark Fainaru-Wada faced potential jail time in the BALCO affair, as did freelancer Sara Olsen in the court-martial of Army Lt. Ehren Watada.

But while these journalists refused to comply with subpoenas that were clearly related to federal matters, there was no such obvious connection in Wolf’s case. An investigation into the assault on SFPD officer Peter Shields normally would have been undertaken by local police and District Attorney Kamala Harris. Police records show that SFPD inspector Lea Militello requested "assistance from the FBI/JTTF regarding investigation of a serious assault against a San Francisco police officer." Federal investigators justified their involvement by maintaining that there had been an attempted arson on an SFPD squad car purchased in part with federal funds, even though SFPD records indicate only that the car’s rear tail light was broken.

"There was nothing incriminating on my tape," Wolf told the Police Commission, recalling how he offered to prove his statement by letting the federal judge view it in his private chambers, an offer the judge refused. "But because I had no federal protections, I had to decide whether to engage in a McCarthyesque witch hunt," Wolf added; he long had suspected that the feds wanted to profile anarchists about whom he has intimate knowledge.

Campos and Sparks hope that last week’s Police Commission discussion will be the first in a series about the protocols and procedures that the SFPD follows in deciding whether to refer matters to federal authorities. Both stress that asking for such a study does not mean they do not care that an SFPD officer was hurt. As Sparks told us, "At this point we don’t know what the deliberations behind everything that night were or how many people were deployed. For us to comment on a police officer being injured is inappropriate unless we have all the information. And all we’re hearing is anecdotal stuff. Our job is not to take sides but to figure out what the policies were, are, and what they should be."

Police Chief Heather Fong has agreed to report to the Police Commission in August on policies and procedures related to the SFPD’s General Orders, the city’s ordinances on immigration and medical marijuana, and protection of journalists’ rights. Sparks predicts that the report will tell the commission "what the SFPD’s policies do, how that compares to the Board of Supervisors’ resolutions, and whether we need to rewrite them or write new rules for the police."

Commissioner Campos told us he hopes the report will clarify whether the police have an obligation to report to the feds if an investigation involves damage to property bought with federal funding. "If it’s the case that we are obligated, then we need a discussion. Do we want to accept funds if doing so ties our hands and forces us to do something that San Francisco doesn’t want to do? For instance, if we accept funding, then does that mean we have to cooperate with [Immigration and Customs Enforcement]? If so, then a lot of us, myself included, would be up in arms and would say, ‘Let’s not.’ To the extent that it comes down to money, I’d hope that we’d make the choice that we’d rather not take the money than get in bed with the federal government."

Wolf, who was not convicted of any crime but served 226 days for being in contempt of a grand jury subpoena, was released April 3 after he agreed to post all his unedited footage online — an action the feds claimed as evidence that he had submitted to their demands. But Wolf pointed out that he agreed to do so only after the feds promised that he would not have to testify about anyone whose actions or words he had captured on tape. He also pointed out that he released the tapes to everyone, not just the federal government.

Since being released Wolf has announced his intention to run for mayor of San Francisco this fall, saying he was inspired by the recent Progressive Convention called by Sup. Chris Daly "in which they had a great platform but no declared candidate."

Wolf’s candidacy pits him against Mayor Gavin Newsom, who expressed neither support for Wolf nor criticism of his detention. That stance is in contrast with that of Harris, who is also running for reelection this fall and publicly criticized the US Attorney’s Office in March, a month before Wolf was released. In August 2006, Newsom returned unsigned the resolution of support for Wolf’s plight that was sponsored by Supervisors Ross Mirkarimi, Tom Ammiano, and Daly. The resolution, which passed on a 9–1 vote, with Sup. Sean Elsbernd voting no and Sup. Michela Alioto-Pier absent, declared that the city "resisted the federal government’s intervention in the City and County of San Francisco’s investigation of the July 8th, 2005 G-8 protest; expressed support for the California Shield Law; and urged Congress to pass Senate Bill 2831, the Free Flow of Information Act."

Asked about Newsom’s position on Wolf and related matters, spokesperson Nathan Ballard reminded the Guardian that the mayor authorized a $10,000 reward for information leading to the arrest and conviction of the person or persons responsible for the assault on Shields. "We take these attacks seriously and will take the appropriate actions necessary to ensure that the person or persons responsible are prosecuted," the mayor said shortly after the assault. As for Wolf, Ballard said by e-mail, "I am not aware of any public statement [by] the Mayor on the case of Josh Wolf. The Mayor is generally supportive of the concept of a better shield law, but he has not taken a position on this particular bill at the present time."

As it happens, Wolf, who has made numerous media appearances since his release, including on The Colbert Report, could find himself in the unusual position of having more name recognition than any of Newsom’s other challengers. And with Congress currently considering a federal shield law, the cause for which Wolf went to jail remains in the news. As media activist Rick Knee put it, pointing to the "Free Josh Wolf" button that he continues to wear on the lapel of his tweed jacket, "Josh may be out, but the issue is still with us." *

Part three in a Guardian series

San Francisco Ethics Commission executive director John St. Croix has admitted that his office knew in 2005 about the alleged laundering of public money into a San Francisco City College bond election campaign — well before the story broke in newspapers in April — but did nothing to investigate.

That startling revelation knits together two concurrent series that the Guardian has been running for the past two weeks: one on City College’s deceptive and unaccountable use of bond money and another on the uneasiness local watchdogs feel about the Ethics Commission’s ability and willingness to mete out balanced punishment to elections-law violators.

When news reports surfaced in April that City College allegedly had diverted up to $30,000 in public money to a bond election campaign committee, Chancellor Phil Day moved quickly to limit the fallout. So did independently elected trustee Rodel Rodis, who along with six other board members is responsible for controlling and managing the San Francisco Community College District.

During meetings organized that month to address the matter, Day came clean and blamed everything on a "relatively new" assistant vice chancellor. At least two trustees, one of whom had been recently elected, still wanted to know more about why it was allowed to happen. Rodis, on the other hand, complained that hiring an independent investigator at a cost of $75,000 to look into the matter was too expensive and framed the stories — written by San Francisco Chronicle investigate reporter Lance Williams — as an unfair attack on the college.

"Let’s be mindful that we’re still in a budget crisis and we still need to watch taxpayer money," Rodis said at one of the meetings.

Unlike Rodis, District Attorney Kamala Harris didn’t treat the allegations as insignificant and is now reportedly probing possible criminal violations in connection with the scandal. The investigation, Williams wrote recently, includes contributions made to the committee by contractors that did recent business with the school.

But where was the Ethics Commission during all of this? The controversy raises serious questions about why the agency never took any action against City College when, as its mission statement declares, its responsibility is to "actively enforce all ethics laws and rules, including campaign finance and open government laws."

Late in the commission’s July 9 meeting, St. Croix made the stunning admission that although his office knew about the allegations surrounding City College’s dubious handling of public funds all the way back in 2005, for some inexplicable reason it did nothing.

Staff shortages and poor financing have plagued the Ethics Commission since voters created it in 1993. Although the number of staffers has doubled during his three-year tenure, St. Croix nonetheless told the Guardian recently that his agency remains dependent on the public to help expose political candidates and campaign committees that break the law.

"We still rely on people and the city being watchdogs," St. Croix told us. "We’re supposed to be the eyes and ears for a lot of things, but we’re still extremely limited."

In this case, however, St. Croix’s office was well aware of allegations that City College bureaucrats had misappropriated public funds. The school’s Board of Trustees, along with Day’s office, created the Committee to Support Our City College in 2005 to convince voters to give the school $246.3 million in bond money to continue with a slate of capital works projects that began in 1997 and now are costing hundreds of millions of dollars more than anticipated.

The owner of a motorcycle training school claimed in a December 2005 letter to the Ethics Commission that he was told by the college to make a rent check for the regular use of school property payable to the committee instead of the school itself. Amazingly, the Ethics Commission pondered contacting the state’s Fair Political Practices Commission to disclose the allegations, which is the least it should have done, but never actually did so, as St. Croix has acknowledged only now.

"I take responsibility for that," St. Croix told us. "I don’t know who actually dropped the ball. But at the time we had less staff and there were a lot of things we were supposed to do and we weren’t doing."

Nor did the Ethics Commission contact the college to demand that it amend its campaign filings from that year to reflect the true source of that $10,000 payment and acknowledge itself rather than the motorcycle training school as a major contributor to the bond committee. St. Croix figured that could happen at the conclusion of the FPPC’s inquiry. Of course, the FPPC didn’t know about the allegations, at least not until the Ethics Commission finally contacted it in May, following the Chronicle‘s front-page stories.

The Ethics Commission’s lax approach to City College oversight also extends to trustees like Rodis, who has his own apparent campaign finance violations from his 2004 reelection campaign. That year, records show, his campaign failed to turn in three key election filings required to ensure that before heading to the ballot box, voters have a chance to see where candidates are getting their campaign money from. The commission sent his campaign several warning letters; just one of the filings finally arrived nine months later.

The trustee pointed to a campaign staffer when we contacted him regarding the tardy campaign statements. "We had someone working on the campaign who was supposed to do that," Rodis told us. "He indicated to us that everything was in order. We relied on him. We paid him. And then we found out later that he didn’t do what he was supposed to do…. It was one of those things that happen when you trust people."

The filing Rodis did manage to turn in shows that of the more than $44,000 he raised for his reelection effort that year, at least $1,700 had no identified donors, and other donations were marred by confusing data entry errors. An internal Ethics memo obtained by the Guardian that discusses the Rodis reelection campaign committee concludes that its poor reporting "appears to be a matter of willfulness and disregard for the law" and what belated filings do exist "present significant data problems." According to the memo, "Based on the record, significant questions remain regarding the true facts of the committee’s financing."

Rodis in 2004 won reelection to the board for the fourth time since he first became a trustee in 1991. According to our conservative estimates based only on the late filings, he could be liable for thousands of dollars in fines. *

David Duer is proud of the volunteer work he’s done with the West Contra Costa Unified School District. He graduated from the area’s school system, as did his kids.

So despite what was sure to be a burdensome responsibility with no pay, Duer, a development director for the UC Berkeley Library, accepted the chance to serve on a committee formed under a state mandate to monitor how the district spent $850 million in bond money authorized by voters in three elections since 2000.

"There are schools all over the district that have been renovated," Duer beams today.

The committee initially proposed meeting every quarter but soon realized that wouldn’t be nearly enough to do the job right and chose to meet monthly instead. Since 2003 it has received full-blown management audits of the school system’s performance every year, with biannual updates from independent professionals not beholden to district bureaucrats.

The story of San Francisco’s Community College District could not be more different.

The oversight committee that’s charged with monitoring $560 million in bond spending has never seen an expansive performance audit, just basic financial reports that show community college officials here seem to be obeying their most fundamental fiduciary duties. The panel meets three times a year for more than an hour and a half each time, and for three years it didn’t even report to the public on City College’s handling of the money, which it’s required to do annually by the state’s Education Code.

The community college committee is hardly made of Rotary volunteers and bored retirees: the list includes San Francisco treasurer José Cisneros and former San Francisco Chronicle publisher Steve Falk, now head of the local Chamber of Commerce.

But even members say the panel has fallen down on the job — and that City College officials are freely shifting around the taxpayers’ cash with little or no accountability.

The mostly decipherable performance reports that West Contra Costa citizens receive, though lengthy, track all of that district’s bond expenditures and give the area’s oversight committee of taxpayers a vivid portrait of how well the school system and its administrators are managing hundreds of millions of dollars in building improvements. Any wonkish jargon in the reports that might mystify the committee is translated in "frank" terms by the outside inspectors, Duer says, without interference from school officials.

If a contractor were to double-bill the district or demand too much in change orders after promising completion within a set price range, Duer and his colleagues would know about it, and they could make suggestions on how to fix it. If the district was doing a stellar job, that would be clear too.

"I don’t see these performance audits as punitive," Duer said. "I see them as a confirmation that the process and systems in place are working."

MORE MONEY PROBLEMS


The Guardian reported last week ("The City College Shell Game," 7/4/07) that City College’s bond projects are running an astounding $225 million over budget. As a result, school officials have returned to the Board of Trustees five times in recent years to request that a total of $130 million be reallocated from one project to another to cover the overruns, leaving some projects promised to voters with little or no funding at all. We reported on a number of examples last week, but there are plenty more:

<\!s> The construction of a new Mission campus was supposed to begin in 2002 but didn’t get under way until well into 2005. The project is now $30 million over budget, an increase of 50 percent, and the school recently requested another $6 million diversion from other bond projects. City College originally planned to build the campus where a shuttered theater currently stands on Mission Street but later moved the site to avoid a showdown with preservationists.

<\!s> Since 1997, City College has asked voters for a total of $61 million to renovate and remodel existing buildings and meet Americans with Disabilities Act requirements. In November 2005 it asked voters for $35 million to perform such work, but just weeks after the election, $20 million of the money was reallocated to a planned Chinatown–<\d>North Beach campus that’s now running $50 million over budget, an increase of 60 percent. That project’s ever-changing design has been heatedly challenged by everyone from the Chronicle‘s editorial board to Sup. Aaron Peskin to state senator Leland Yee.

<\!s> Two projects for which voters authorized a combined $71 million won’t see the light of day unless the college returns to the ballot a fourth time, which school officials have discussed. The projects — a biotech learning center and a one-stop administrative shop for new students — have been drained of $42 million to save the Mission campus and an overdue Performing Arts Center, which will cost $75 million more than expected, an increase of 152 percent.

HUNTING AND PECKING


All of this irks Mara Kopp, who was appointed to City College’s oversight committee in late 2005 as a representative of the San Francisco Taxpayers Association. She’s complained openly that the school long ago should have hired auditors for the kind of far-reaching work West Contra Costa gets.

"If we received ongoing management reports, then we’d have something of substance," Kopp said. "We wouldn’t have to hunt and peck in a kind of naive, elementary way."

She is all but alone in her criticism, however, save for a small group of allies including former committee member John Rizzo and Milton Marks, one of the few voices on the independently elected Board of Trustees willing to apply tough scrutiny to Chancellor Phil Day’s office at board meetings. Green Party pol Rizzo recently became a trustee after closely beating longtime incumbent Johnnie Carter in the November 2006 board race.

Day has long argued that the school’s attorneys don’t believe such audits are required under Proposition 39, a 2000 state ballot measure that lowered the threshold for passing local school bonds. Prop. 39 required the formation of local citizens’ bond oversight committees.

Marks has questioned the strength of City College’s oversight committee and the lack of performance audits since at least 2005, but not until earlier this year were he and Rizzo able to force a resolution demanding the inspections, and now Day claims to welcome a management review. The school will bid out its first audit soon.

"The bottom line is, a performance audit as opposed to a financial audit would determine whether or not funds are being expended in the most efficient, effective, and economical manner instead of just adding up these funds and saying, ‘Here’s how much we expended and for what,’<\!s>" said Harvey Rose, a respected local auditor who’s reviewed city agencies and analyzed San Francisco’s annual budget for 35 years.

West Contra Costa concluded that Prop. 39 does require extensive managements audits. The committee even decided to include a $150 million bond election in 2000 in the scope of its work, although that wasn’t required, to ensure all the money was still being spent efficiently.

Duer said it doesn’t matter to him what the letter of the law requires. "It was always assumed with our work that this is something we had to have," he said.

The Los Angeles Community College District made the same assumption. Other districts statewide, however, appear to have interpreted Prop. 39 the same way City College has. And the Attorney General’s Office has never issued an opinion clarifying the matter.

Meanwhile, City College officials blame the millions of dollars in outsize project costs on inflation, a globally increased demand for steel and concrete, and slow-moving state regulators who must approve architectural designs.

"I understand both the college as well as the community would like to see us complete every single project we’ve proposed," Vice Chancellor Peter Goldstein told us recently. "We absolutely share that desire. The reality of cost increases has forced us to go back and look at our resources and reallocate in order to keep major projects going forward."

But Kopp and company argue that much earlier performance inspections would have revealed to the oversight committee and trustees where the increase in expenses came from with absolute certainty. That way, no one would have to rely exclusively on the glitzy project presentations made by Day and Goldstein that are often little more than slide shows with quotes from prominent business journals decrying the rising cost of construction materials. Trustee Marks has moaned repeatedly at board meetings that he doesn’t feel informed enough to vote on major reallocations, and his constant questions haven’t always made him popular.

"I think there’s this feeling that the board should not be adversarial," Marks said. "But I think by the nature of how things are set up, we have to be…. We have to look out for the best interests of the public at large."

Not everything’s rosy in West Contra Costa, of course. Anton Jungherr, a former San Francisco Unified School District official, sat on the West Contra Costa oversight committee for four years and fumed in an interview that the district didn’t take seriously the committee’s regular recommendations. He wants to form a statewide association of oversight committees to arm citizens with the information they need to track bond expenditures.

"There are legitimate reasons for change orders, but you have to analyze them and understand what the reasons are and then take the appropriate oversight action," Jungherr said.

But cost overruns in West Contra Costa still pale when compared with those at City College. Jungherr said that district has experienced about $100 million in unexpected costs on $850 million in projects undertaken since 2000, substantially less than what City College faces despite hundreds of millions of dollars more in bond projects.

Kopp still hopes City College’s oversight committee will build more muscle.

"If they were to show us documents they used themselves in monitoring all these things, that could substitute as long as the information was relevant and honest," Kopp said. "But it’s really been quite shallow all along."<\!s>*

The Chronicle’s looney

The San Francisco Chronicle apparently thinks a retired Wall Street Journal reporter who now lives in Berkeley and who wrote a remarkably homophobic piece on San Francisco politics way back in 1995 is the perfect persion to comment on the current Board of Supervisors. His piece, on SFGate, has the headline “Clown Show: The Board of Supervisors SF deserves? His point, it appears, is that the large queer community in San Francisco and the looney liberals here have elected a bunch of crazies to the board.

I would ignore this shit, except that it comes in the wake of all the Chris Daly bashing (much of which is factually inaccurate — Daly never accused the mayor of doing cocaine) and will, no doubt, fuel a new attack on district elections.

So let’s be real here: This district-elected board is hardly a crew of wackos. The board has done exceptional work over the past few years, passing landmark legislation that has put San Francisco in the forefront of American cities on progressive policy.

Fix Newsom’s bad budget

EDITORIAL Annual budgets can seem wonky and impenetrable, but they’re perhaps the most important statements of a city’s values and priorities. That’s why it’s critically important for the Board of Supervisors to make significant changes to Mayor Gavin Newsom’s proposed $6 billion spending plan, which is out of step with what San Francisco should be about.

Ideally, this month’s budget hearings would be informed by an honest and open discussion of what Newsom proposed in his June 1 budget, how it affects residents and Newsom’s political interests, and where the board might want to make some changes.

Unfortunately, both the San Francisco Chronicle and the Examiner have failed to offer a substantial analysis of the budget; instead, they’ve focused on sensational headlines about whether the mayor has used cocaine, personality conflicts between Newsom and Sup. Chris Daly (including a pair of over-the-top hit pieces on Daly in the June 23 Chron), and misleading spin coming from Newsom’s office and reelection campaign.

But there’s plenty of good budget analysis out there, thanks to the work of city agencies such as the Controller’s Office and the Board of Supervisors’ Budget Analyst Office, nonprofits like the People’s Budget Coalition, smart citizens like Marc Salomon, and reporting by the Guardian‘s Sarah Phelan ("The Budget’s Opening Battle," 6/20/07) and Chris Albon ("Newsom Cuts Poverty Programs," 6/20/07).

What that analysis shows is that the mayor’s much-ballyhooed "back-to-basics" budget — which prioritizes public safety, cityscape improvements, home ownership programs, and pet projects such as Project Homeless Connect — would make unconscionable cuts to essential social services and affordable housing programs, rely way too much on gimmicks and private capital to address public needs, and offer almost nothing that is innovative or befitting a progressive city at a crucial point in history.

Some specific examples and recommendations:

Newsom’s 4 percent cut in the Department of Public Health budget — which his appointed Health Commission took the unusual step of refusing to implement because the fat has already been trimmed away in previous budgets — is unacceptable. It would slash substance abuse treatment, homeless and HIV/AIDs services, and other programs that would simply be unavailable if the city didn’t fund them. The board should fully restore that funding and even consider providing seed money for innovative new programs that would help lift people out of poverty. Only after the city fully meets the needs of its most vulnerable citizens should it consider cosmetic fixes like expanded street cleaning.

• The budget should strike a balance on cityscape improvements that is lacking now. Contrary to the alternative budget proposed by Daly, which would have cut the $6.6 million that Newsom proposed for street improvements, we agree with the SF Bicycle Coalition that many streets are dangerous and in need of repair. It’s a public health and safety issue when cars and bikes need to swerve around potholes. But the $2.9 million in sidewalk improvements could probably be scaled back to just deal with accessibility issues rather than cosmetic concerns. And we don’t agree with Newsom’s plan to add 100 blocks and $2.1 million to the Corridors street-cleaning program, which already wastes far too much money, water, chemicals, and other resources.

As we mentioned last week ("More Cops Aren’t Enough," 6/20/07), the police budget doesn’t need the extra $33 million that Newsom is proposing, at least not until he’s willing to facilitate a public discussion about the San Francisco Police Department’s mission and lack of accountability. Sup. Ross Mirkarimi (a progressive who is strong on public safety and even clashed with Daly over the issue) was right to recently challenge the terrible contract that Newsom negotiated with the cops, which gives them a 25 percent pay increase and asks almost nothing in return.

Newsom’s housing budget would move about $50 million from renter and affordable-housing programs into initiatives promoting home ownership, which is just not a realistic option for most residents and represents a shift in city priorities that serves developers more than citizens. Some of that change is specific to a couple of big owner-occupied yet fairly affordable projects in the pipeline for next year, but the budget also does little to address the fact that we are steadily losing ground in meeting the goal in the General Plan’s Housing Element of making 62 percent of new housing affordable to most residents, when we should be expanding these programs by at least the $28 million that the board approved but Newsom rejected. Similarly, the board should keep pushing the Housing Authority to apply for federal Hope VI funds to make needed improvements to the public housing projects rather than supporting Newsom’s Hope SF, which purports to magically turn a $5 million expenditure into $700 million in housing — as long as we accept the devil’s bargain of 700 to 900 market-rate condos along with the public housing units.

Finally, there are lots of little items in Newsom’s budget that could be cut to find funding for more important city priorities. Don’t give him $1.1 million to hassle the homeless in Golden Gate Park or $700,000 for his New York–style community court in the Tenderloin.

The bottom line is that a progressive city should not be pandering to the cops, punishing the poor, and polishing up its streets when so many of its citizens are struggling just to find shelter and make it to the next month. Newsom has forgotten about the ideals that the Democratic Party once embraced, but it’s not too late for the Board of Supervisors to correct that mistake. *

The future of paper

TECHSPLOITATION Twenty years from now, paper will no longer be a tool for mass communication. Instead it will be a substance akin to plastic, a mere fabricated building material with industrial and consumer applications. At least, those were the thoughts that ran through my mind when I received a strange news release last week from a Finnish company called VTT, which trumpeted a business model that included developing new products based on what it called "printing technology" and "paper products." VTT has developed a prototype for bioactive paper that responds to enzymes and biomolecules by changing color. One idea is to use it in food packaging or air filters to get an early warning about toxins.

Weird innovations are great, but the most interesting part of this news release was about markets: "The goal is … to create new business for the paper industry … to introduce new innovations and market initiatives between the traditional ICT [information communication technology] and paper industries by combining IT, electronics and printing technologies."

Let us parse the high-flown language of commerce. VTT is saying the paper industry needs new markets, and high-tech, bioactive paper will help create them. But why? Obviously, paper has its uses — there are newspapers, magazines, notepads, and books to be printed! Why worry about making the stuff bioactive when you can just sell it to Random House or Conde Nast? You already know the answer. Print communication is dying out, and with it goes the paper industry. Over the past few months, I’ve witnessed the two biggest daily papers in my area, the San Francisco Chronicle and the San Jose Mercury News, announce budget cuts that will slash their staffs by one-quarter. What does that mean for the paper industry? Fewer orders for newsprint.

When Karl Marx wrote that every great historical event occurs twice — "first time as tragedy, second time as farce" — I doubt he had print media in mind. And yet the upset of the paper industry feels to me like the joke that comes after the tragedy of print media’s fast decline. Don’t get me wrong: I’m not one of those people who think that barbarians are storming the gates because anyone can publish their ramblings on MySpace instead of having to get David Remnick’s permission to publish their ramblings in the New Yorker. Still, I cannot help but feel wrenchingly bad when I think about what it will be like in the Mercury newsroom after a quarter of the editorial staff has left the building.

I won’t miss the paper, but I will miss the journalists.

What’s tragic is that print journalism has not tried to diversify its market as methodically as the paper industry has. Right now, VTT is just one of many companies trying to figure out cool new ways to use paper. But who is trying to figure out cool new ways to employ smart, highly trained print journalists? Maybe Dan Gillmor and a few other people running small nonprofits. But mostly, print journalists are having to figure the future out on their own.

Some will do what I’ve done, gradually moving from print media to online. I’ve gone from a print zine to an online zine to a weekly newspaper to print magazines to running a blog. This column you’re reading is syndicated to both print newspapers and Web sites. Nobody gave me guidance. No slick marketing dude from Finland came in and said, "Hey, maybe you should diversify and start creating bioactive journalism." Instead, I fumbled along on my own, trying to find the most stable place where I could settle down and write for a living. Other journalists won’t be as lucky or as willing to change. They may stop writing; they may become shills for the companies they once investigated; they may feel bitter or liberated or panicked. None of them deserve it. Somebody should have helped them get ready for this transition five years ago.

I live in a world where corporations care more about the future of paper than the futures of people who have made their living turning paper into a massive network of vital, important communications. This is not how technological change should work. You cannot discard a person the way you discard a market niche. That’s because people revolt. Especially journalists. *

On the front page of today’s San Francisco Chronicle, June 2l, Mayor Gavin Newsom is pictured, grim, scowling, arms clenched, over this caption:

“Mayor Gavin Newsom denies Supervisor Chris Daly’s suggestion that he has used cocaine. “That’s how low politics now has gotten in this city, and I seriously thought it couldn’t get much worse.”
The story by City Hall Reporter Cecilia M. Vega had this head: “CITY HALL UPROAR AT COCAINE CLAIM,” with this subhead, “Angry Newsom blasts Daly for bringing politics to a new low.”

This jolly back and forth, I submit, is far from a new low. (See City Editor Steve Jones’s blog in our politics blog.)
For starters, I would submit there is a new new low and a most timely new new low at that. This new new low is the fact that Newsom, despite the public power mandates of the federal Raker Act, the U.S. Supreme Court, and the crucial Ammiano/Mirkarimi CCA legislation approved by the Supervisors only last Tuesday, reversed his public pledges supporting CCA and public power and clambered into bed in hot embrace on Tuesday with PG&E. (See my previous blog.) He allowed PG&E to call the shots in a PG&E-arranged and PG&E- promoted press conference at the Presidio announcing that the city in effect was turning over its public study of tidal power to the private utility that has perpetuated the PG&E/Raker Act scandal for decades.

This is the new new low: the scandal of how the mayor of the City and County of San Francisco, after PG&E has privatized and stolen the city’s cheap, green Hetch Hetchy power, and after PG&E helped privatize and steal the Presidio, was in effect turning over the choppy waters of the bay and the ocean to PG&E to privatize and steal. Incredible. Newsom was doing his damndest to put PG&E in the catbird seat on the next giant step on power generation and to further entrench the illegal private utility in City Hall. No wonder Newsom gets so “agitated” over the handy dandy issue of whether he did or did not use cocaine.

The slow fade of Sly Stone

FULL CIRCLE This spring Epic/Legacy finally started releasing Sly and the Family Stone: The Collection, the band’s seven albums complete with previously unreleased music, new liner notes, and great sound, with the final installment, Greatest Hits, to come July 24. The event had been on the horizon for some time, but like everything connected with Sly Stone, a fan was never sure when — or if, for that matter — the music would be available.

If you aren’t familiar with Stone’s music, get this collection and enjoy. These days it’s popular to credit the Beatles, Brian Wilson, Jimi Hendrix, and a few others as the essential pioneers from that era — with no mention of Stone, who was as important as any. If you’re wondering why that is, find the title track from his hugely popular 1971 album, There’s a Riot Goin’ On. It’s on the brief side — as in zero seconds, which was Stone’s idea of a joke or something. As San Francisco Chronicle writer Joel Selvin points out in the notes, the riot was going on in Stone’s life.

There was a moment in the late 1970s when music fans were asking, "What happened to Sly Stone?" Time passed, and the question evolved into "Whatever happened to Sly Stone?" The answer — "I don’t know" — didn’t change, until one day, sadly and inevitably, the question generated only another question — "Who?" — an answer all by itself.

In the early 1980s — somewhere between "what" and "whatever" — the band booked a show at the now-defunct Keystone Berkeley. Stone had gone phantom, which made the performance an event. Accordingly, the place was packed. The band was introduced and began to vamp, and after way too long — it was clear the Family didn’t know what to expect — Stone emerged and took his place behind a keyboard and, without acknowledging anyone, began to play. The band was thrown at first, but after a few halting bars and some nervous glances, they seemed to recognize the groove. Never mind the key or tempo, or where they should jump in. It didn’t matter, because suddenly Stone lurched into something else, with the same result. A moment later he did it again. And again. And again.

The set didn’t last more than a few minutes. That was the upside. The downside? Everything else.

Yet forgotten or not, Stone was once arguably the most important figure in pop. During the late 1960s and early ’70s, the Vallejo native wrote and recorded one hit after another: "Dance to the Music," "Everyday People," "Stand!" "I Want to Take You Higher," "Hot Fun in the Summertime," "Thank You (Falettinme Be Mice Elf Again)," "Family Affair." He brought black music to San Francisco’s tumultuous hippie scene and created rich, innovative, rock-flavored R&B, played by a deliberately integrated band. Rock fans — most of them white — welcomed the bridge to black music and, by inference, black people. If the door didn’t swing as wide or as often the other way, a glimpse of the band’s appearances on YouTube, which has great Family Stone material, shows a genuinely mixed audience responding to the group’s appeal for peace and understanding.

Stone was a founding father of modern funk, a wildly creative force who added innovations to the sound as it flourished. His music reshaped the tastes of black and white listeners, and one miserable Sunday morning in August 1969, his band took the Woodstock stage — it was 3:30 a.m. — and absolutely stole the show.

You can only hope The Collection will have a similar impact. The band’s four pre-Riot albums offer a treasure chest of rich, increasingly funky soul. No matter how cynical Stone became — the black superstar playing to a largely white audience, the musical genius forced to pander to the tastes of a pop audience, the master manipulator turning every scene to his own advantage — the music was charming and irresistible. As was the man who created it.

Although some of his most important work was still before him, Stone ushered in the 1970s in paranoia and retreat — a perfect fit with the moment. He flipped off superstardom with an arrogance only a superstar could muster. Once outgoing and engaging, Stone burned promoters, his band, and fans. The once-steady supply of new material slowed to a trickle, and Stone became a no-show at dozens of concerts. He slid into an increasingly opaque and eventually impenetrable world. Riot and 1973’s Fresh — forget 1974’s Small Talk — were as adventurous and self-involved as music could be. Most of the original Family was gone, and the losses of drummer Greg Errico and bassist Larry Graham — who reportedly slept with one eye open after falling out with Stone — were particularly felt. This music was dreamy and solipsistic. Stone’s huge smile and the Family vibe were gone, replaced by a menacing undercurrent. Credits on both albums are, apparently, haphazard, which means that the contributions of Miles Davis, George Clinton, and Bobby Womack, for instance, aren’t acknowledged.

That Stone could attract such talent was a testimony to his gifts, and to the legendary partying that went on at his Los Angeles mansion. Still, if James Brown invented funk, Stone got in where he fit in: the ground floor. Riot may clock a man losing his grip on reality, but it also captured a musical innovator exploring the possibilities of a crucial movement. *

Merc workers plan protest of job cuts

UPDATE! I failed to include a date for the protest first time around. It will be this Tuesday, June 26.

Employees of the embattled San Jose Mercury News announced earlier today that they intended to picket the newspaper over expected job cuts at the peninsula daily.

The jobs of 30 ad-production workers will immediately be affected, and editorial and composing room employees were already facing planned cuts.

The paper also announced today that it would be getting rid of its Perspective section, which appears on Sundays, due to “relatively low readership.” We reported recently that the Chronicle has been considering a similar cut to its Insight section, from which longtime editor Jim Finefrock was recently let go.

Production-side employees from the Merc represented by the Northern California Media Workers Union planned a protest for today stating in a press release that the cuts would only help to expand the newspaper empire of William “Lean” Dean Singleton, head honcho for MediaNews Group, which leads a consortium of newspaper companies that owns the Merc along with just about every other major daily in the Bay Area save for the San Francisco Chronicle.

The Merc’s union complained that some MediaNews Group positions had already been outsourced to India from Contra Costa County and Pleasanton.
