An agenda as clear as 1, 2, 3

Downtown hates democracy. Entities like the San Francisco Chamber of Commerce and San Francisco Chronicle prefer elections with well-financed frontrunners willing to do their bidding. They don’t like messy democratic exercises like this year’s mayoral elections, in which the crowded field of solid, evenly matched candidates will be looking for support from progressives as part of their ranked-choice voting strategies and any of several candidates could win.

That’s why the Chamber/Chronicle are hyperventilating about the ranked-choice voting system, which resulted in a candidate from outside the acceptable establishment becoming mayor of Oakland, a result they fear might also happen here. The latest attacks come in a pair of misleading stories in today’s Chronicle, based on a loaded Chamber poll.

The main story ran front page above the fold, the big headline calling the seven-year-old voting system “a mystery” because the poll found many voters didn’t know precise details about how votes are tabulated. And even though the poll found “voters evenly split on whether they prefer the current system or a runoff,” according to the story, columnist CW Nevius writes that the poll shows voters “would prefer a two-candidate runoff.”

No, Chuck, you and your fearful downtown cronies prefer elections like that: costly, low-turnout elections in which the better financed and more conservative candidate wins every time. But most people are content with the current system, and they have a strong record of knowing how to use it and how it basically works, which why the paper reluctantly admits at the end of the story that voters preferred this system more than 2-1 in a 2009 poll.

Even without knowing how the Chamber asked the question (we’re still waiting for a response to our request to review the poll questions and data) in the current poll, and even in a newspaper with a consistent record of wanting to repeal this voting system along with other progressive reform like district election and public financing, as many respondents to this obviously leading poll said they preferred this system as did those who don’t like it.

But you better believe that the Chronicle/Chamber are going to do everything they can to scare and confuse voters into losing confidence in ranked-choice voting. Spotting these thinly veiled Chronicle/Chamber crusades is as easy as 1, 2, 3.

UPDATE: The Chamber did forward us its poll questions, including this one: “As far as you know, in an election that uses ranked choice voting, if your first choice, second choice and third choice candidates are all eliminated when the votes are tallied, what happens …. (ROTATE) is your vote counted or is your vote not counted … (READ LAST) or are you unsure?”

The results: 55 percent unsure, 29 percent “your vote is counted,” 15 percent “your vote is not counted.” And this confusing question is the basis for the Chron’s conclusion that “a majority of voters don’t know how the system works.” Actually, voters seem to understand just fine that they get three choices, that they ranks them in order of preference, and that there is a system for reassigning their votes as their top choices are eliminated. In this question, one might argue that the voters whose top three candidates were eliminated had their votes counted three times. Or you could say it wasn’t counted. It’s basically a philosophical question that was clearly intended to confuse respondents, and it worked. But they only way that would justify the screamer headline and high play for this story is if the Chron/Chamber was pushing an agenda.

Stories for big kids: Tales hit the stage with Paul Flores, the Living Word Project, Campo Santo, and Word for Word

Stories aren’t just for youngsters who read The Very Hungry Caterpillar before bed or tell scary tales around a campfire. The big kids need stories too, and lucky for San Francisco, the city boasts dynamic performers enacting mature and human stories on stage. Feeding complex chronicles to the souls of grown up audience members, Paul Flores, Living Word Project, Campo Santo and Word for Word do their parts to prove stories for big kids rule.

In You’re Gonna Cry, a one-man show about the effects of Mission District gentrification performed in February at Dance Mission Theater, Flores embodied about a dozen neighborhood characters. Ranging from a Latino bohemian, a pink-haired DJ, and an elderly dumpster-diving immigrant, to a salsa-dancing old timer, a drug dealer, and a well-meaning business man, the personalities illuminated his story from diverse perspectives.

With versions of each character walking the streets in real life, You’re Gonna Cry‘s tales resonated. “The project is not meant to be consumed passively, but to move people to respond and take action,” Flores wrote in the program notes, revealing his intention to employ art for social change. The call to action: empathy, respect, and support for one’s neighbors, and acknowledgment of the cultural nuances in the Mission District. For Flores, hip-hop theater and storytelling helped to put a human face on the issue. 

A Def Poet, playwright, novelist, and spoken-word artist, Flores continues to make a huge impact on teens as a co-founder of Youth Speaks, which implements programs connecting poetry, spoken word, youth development, and civic engagement. The resident theater company of Youth Speaks, the Living Word Project extends the reach of  personal narratives, emphasizing spoken storytelling to communicate important social issues and current movements. Living Word Project Artistic Director Marc Bamuthi Joseph, also a former Def Poet, works closely with a select group of writers and performers, whose ages span from 19 to 25, for the productions.

Excerpts from the Living Word Project’s Word Becomes Flesh appeared in December of last year at YBCA’s Left Coast Leaning festival, co-curated by Joseph. There, committed performers enacted letters to an unborn son, with electrifying physicality and rapid-fire wordplay. The work presented a counter-narrative to the narrow frame of current commercial hip-hop, breaking stereotypes. Through performance, the group focused on the oral transfer of a story, directly confessing personal thoughts and emotions to make connections. Watch for them with Campo Santo at Intersection for the Arts this November in Tree City Legends, written by Dennis Kim of Denizen Kane and directed by Joseph.

Campo Santo, the resident theater company at Intersection for the Arts led by Sean San Jose, plays a major role in theatrical storytelling, linking writers to the stage. “Campo Santo is Spanish for sacred ground,” the group’s artist statement declares. “Like the roots of our name, we are taking the sacred form of storytelling and using it as a tool to bond community through socially relevant plays.”

In May, Campo Santo performs for the first time in Intersection for the Arts’ new home at the San Francisco Chronicle Building, presenting Nobody Move, based on the book by Denis Johnson. Adapted by San Jose, the performance offers a noir psychic picture of the United States from an outsider’s seat. In September, Campo Santo continues its work with Pulitzer Prize-winning author Junot Diaz when it presents The Pura Principle, created from Diaz’s recent short stories and original writings. Also expect storytelling to be part of this year’s Bay Area Now Triennial at Yerba Buena Center for the Arts, where San Jose is one of several curators for performances during the final months of 2011.

Another group breathing life into short stories is the Word for Word Performing Arts Company, operating at Z Space. Founded by Susan Harloe and JoAnne Winter, Word for Word is known for staging performances of classic and contemporary fiction, enabling the company to tell literary stories with theatricality. Word for Word’s last show was extended due to its popularity and positive critical reception. This week, The Islanders opens at Z Space, telling about the bonds of friendship – as two women reunite for a trip to Ireland — by bestselling author Andrew Sean Greer, directed by Sheila Balter. 

While some degree of storytelling already exists in most narrative theater work, the outward expression of a story onstage shifts the performances of Flores, the Living Word Project, Campo Santo, and Word for Word into distinct territory. By combining narrative and literature with powerful theatricality, these San Francisco performers make clear that stories are for people of all ages.

Waste not

The San Francisco Board of Supervisors has delayed consideration of a city waste disposal contract while officials investigate a broad range of questions ranging from logistical considerations to whether to break up Recology’s current garbage collection monopoly.

Is it feasible to move the city’s entire infrastructure for waste and recycling to the Port of San Francisco? Would it be more sustainable to barge or rail the city’s trash directly from the port rather than drive it across the Bay Bridge to Oakland every day? Considering that recyclables get shipped from Oakland to Asia anyway, why not send them by barge rather than truck? Or is that idea just an empty gesture since recycles, mostly paper products, consitute only 10 percent of the waste stream?

Some of these questions are being studied as part of a survey the San Francisco Local Agency Formation Commission (LAFCO) is trying to complete by April, others as part of a longer-term investigation by the Department of Environment (DoE). At LAFCO’s Feb. 28 meeting, commissioners requested a survey of how other jurisdictions in the Bay Area procure trash collection, hauling, and disposal contracts.

Although the studies differ in scope and duration, both were triggered by a Feb. 3 Budget and Legislative Analyst (BLA) report that revealed that the annual cost to ratepayers of San Francisco’s waste system is $206 million. Yet only the $11 million landfill contract is being put out to competitive bid (see “Garbage Curveball,” 02/08/11).

The BLA report revealed that a 1932 ordinance intended to address territorial disputes around trash collection and transportation in San Francisco ultimately gave Recology (formerly NorCal Waste) a monopoly on all post-collection recycling, consolidation, composting, long-distance transport to landfills, and waste disposal contracts. The report triggered a political firestorm by recommending that the city replace existing trash collection and disposal laws with legislation that would require competitive bidding on all waste contracts and that rates for residential and commercial trash collection become subject to Board of Supervisors approval.

Faced with these recommendations, the Board of Supervisors Budget and Finance Committee asked Feb. 9 for a two-month delay on DoE’s proposal to award Recology a 10-year contract to dispose of San Francisco’s municipal solid waste at Recology’s Ostrom Road landfill Yuba County when its contract at Waste Management’s Altamont landfill expires.

DoE officials predict the WM contract will expire in 2015. But company representatives estimate the contract will last much longer, based on reduced volumes that San Francisco has been trucking to Altamont.

Sup. John Avalos, a LAFCO commissioner, requested that the LAFCO study include a map to give folks “a visual” of landfill locations throughout the greater Bay Area. “And there’s been an interesting discussion about the use of barging,” Avalos said, pointing to the flotilla of barges involved in building the Bay Bridge, which could be repurposed when that jobs ends. “A new maritime use could help the port raise revenue and reinvigorate other maritime uses on its property.”

At that point in the hearing, Sup. Ross Mirkarimi, the vice chairman of LAFCO, floated his “alternative barge plan,” under which only recyclables would get sent across the Bay to Oakland. Noting that he has met with Port Director Monique Moyer and Office of Economic and Workforce Development staff, Mirkarimi said that “the port is not equipped to deal with solid waste. But it is equipped to deal with recyclables, so this is something we should pursue.”

But Sup. David Campos, the chairman of LAFCO, clarified that the survey should still include a study of barging all trash. “Barging is complicated, but this is about providing basic information,” he said.

Records show the port reached out to DoE in 2009 with a letter that identified rail (but not barging) as an environmentally sustainable mode for moving waste from the city to its next landfill site.

In a June 23, 2009 letter to the DoE, Moyer and David Gavrich, president and CEO of the SF Bay Railroad (SFBR), stated that “rail directly from the port can not only minimize environmental impacts, it can provide an anchor of rail business for the port and a key economic development engine for the Bayview-Hunters Point community and the city as a whole.”

Recology’s trucks currently collect and haul about half the city’s waste to its recycling center, which sits on port-owned land at Pier 96. After the recyclables are offloaded for processing, the trucks haul the rest of the garbage through the Bayview and back onto the freeway to Brisbane, where it is loaded onto bigger trucks that haul the trash over the Bay Bridge each night to WM’s Altamont landfill near Livermore.

“It would seem most efficient to not double- or triple-handle the waste but to put it directly onto rail at the port instead,” Moyer and Gavrich wrote in 2009. “Collection vehicles could then go directly back out onto their routes, reducing time, fuel, emissions, and traffic impacts.”

The pair noted that SFBR and its affiliate Waste Solutions Group have used rail to haul more than 2 million tons of waste directly from the port in the past 15 years, using gondolas and 12-foot high municipal solid waste (MSW) containers on flat cars. They included an aerial photo showing Recology’s central recycling facility at Pier 96 and the extensive rail infrastructure and barge options that surround the facility.

But DoE never got back to them, Gavrich recalled last week as he fired up a SFBR locomotive and rode the rail tracks that crisscross the 20-acre port-owned facility that lies between SFBR’s outfit, Recology’s Pier 96 recycling facility, and the bay that is currently home to idle barges and rail cars that sit rusting a stone’s throw from the economically depressed Bayview.

“All that’s needed is two to four acres for an excellent transfer station,” Gavrich said. “Barge and rail access could not be better. It’s just waiting to be developed.”

In February, DoE officials told the Budget & Finance Committee that they had looked into and rejected barging as an option. But it turns out they did not conduct an official study. “There hasn’t been a study to date,” DoE’s Assmann said March 7, when the Guardian requested DoE’s barging report. “We had a discussion about it, but no formal policy.”

Assmann noted that DoE asked waste management companies that bid on the city’s landfill disposal contract to include a barging option. “But nobody did,” Assmann said, referring to Recology and Waste Management, the two finalists in the city’s landfill disposal contract bid process.

Assmann said DoE is currently doing a long-term study into three transportation and facilities options for waste using port facilities: the first option would involve moving the entire infrastructure for waste and recycling to the port. The second would be to use the port as a transfer facility for garbage, and truck, barge, or rail haul garbage from the port. The third would involve barging recyclables only from Pier 96.

Assmann notes that the majority of infrastructure for the city’s waste system is at Recology’s Tunnel Road facility on the San Francisco-Brisbane border, a situation he claims would make it impossible to design, permit, finance, and build new facilities at the port before 2015.

But Barry Skolnick, WM’s vice president for Bay Area operations, told the Guardian that 2016 is a more realistic estimate of the landfill expiration date. “At the current disposal rate, we do not believe San Francisco will exhaust its disposal volumes under the existing Altamont landfill contract until 2016 at the earliest,” Skolnick said. “There is plenty of time for the Board of Supervisors and LAFCO to explore best practices and options for its collection, recycling, composting, transferring, and residual waste disposal services.”

Skolnick noted that WM discussed extending the Altamont contract at the Budget & Finance Committee hearing and the LAFCO hearing, and is proposing to extend the city’s current contract by several years.

“We are preparing a proposed three-year extension of the disposal agreement for San Francisco’s review this week,” Skolnick said. “The extension would involve a price increase for disposal but less than the disposal rate offered under the proposed Recology rail haul to Ostrom Road in Yuba County. The three-year extension would provide disposal at the Altamont until 2019 or 2020.”

But Assmann noted that Recology, which currently pays the port $1 million a year to lease Pier 96, wants to expand its Brisbane facility on Recology-owned land. “We have offered to analyze [the Brisbane expansion] option,” Assmann said, estimating that a new transfer facility would cost $40 to $60 million, while a new integrated facility would cost $200 to $450 million.

“If the infrastructure moved to the port, that would have big positive implications for the port,” Assmann said, acknowledging that the port would lose money if Recology relocates entirely to Brisbane. Plus, Brisbane might demand fees from a new facility, he noted. “But consolidation would save ratepayers money in the long run because the operation would become more efficient.”

Unlike the LAFCO study, DoE won’t have its report ready by April, when the city needs to decide on the landfill contract.

“Our proposal is to look at the bigger picture,” Assmann said. “If the board approves Recology’s landfill contract, we’ll still go ahead and do it. The board can always delay its landfill decision. But this looks at infrastructure the landfill agreement won’t impact.”

DoE recommends working with Recology to implement a pilot program to barge recyclables from Pier 96 to the Port of Oakland as it studies long term infrastructure options including locating infrastructure at the port, Assmann said. DoE also recommends that the proposed plan to award Recology the landfill contract and facilitation agreement remain the same “since our analysis shows (and the port concurs) that all options for utilizing the port for any kind of landfill transportation would require a permitting process that would last a minimum of five years and a total timeline of at least seven to nine years.”

So far, the landfill contract has not come before the full board because of delays and continuations at the Budget & Finance Committee. As Judson True, legislative aide to Board President David Chiu, recently observed, the process over the last few months has raised more questions than answers, including unexpected angles such as how the port can be better utilized and the implications of the 1932 refuse collection and disposal ordinance. “We need to get these answers before we can move forward,” True said. “We all have a lot of work to do before we can figure out what’s best for the city and pick a path.”

But Gavrich hopes history doesn’t repeat itself and that Chiu shows some leadership on the garbage contract hornet’s nest. “There are so many compelling reasons and benefits for the city — but that hasn’t stopped the city from doing the wrong thing in the past,” Gavrich said. Gavrich pointed to 2007, when all members of the board except Sup. Chris Daly voted to give the sewage sludge contract to Recology even though its bid was $3 million higher than the competitor, S&S Trucking.

A Dec. 14 2007 San Francisco Chronicle article by Robert Selna quoted Mirkarimi as saying that a key reason for awarding the contract to Recology was that it was a union company. “That’s the elephant in the room,” Mirkarimi said, framing the board’s decision to go with Recology as being about “the devil we know.” Selna recently left the Chronicle to work as Mirkarimi’s legislative aide.

Mirkarimi’s recent suggestion that LAFCO explore barging recyclables as a pilot program has Gavrich worried. “Saying let’s explore simply barging recyclables makes no sense. It’s a fraction of what makes barge/rail haul economically viable.” Gavrich said. “It would put a greater burden on the ratepayer than the economic and environmentally inefficient system they have in place at Pier 96. The port should get the deal. It would be a cash cow.”

The Chronicle doesn’t like democracy

Remarkable editorial in the Chron today on the mayor’s race. The point seems to be that there are too many candidates:


If most of this herd stays in the race, no door knob, mail slot or voice-mail queue will be safe.


Too many people running for office. Too many choices for the voters. Imagine how awful that could be. And to what do we owe this tragic set of circumstances? Ranked-choice voting and public financing.


. Public financing and ranked-choice voting both won voter approval, though it’s fair to say that this season’s prospects were never imagined. Now comes the hard part of living with the results.


There’s nothing in the editorial that says why more democracy is bad, except that San Franciscans will get a lot of campaign fliers and voice mails. And I think the Chron is utterly wrong: this season’s prospects were exactly what supporters of those two progressive refroms had in mind.


Public financing means a wider range of candidates, with a wider range of perspectives, can enter the race. When it was all about who could raise the most money, nobody really had a prayer of getting elected without a million dollars — and there’s no way all eight of the current serious contenders could have raised that kind of money. So a candidate with less proven fundraising ability (say, David Chiu) would be pushed aside by someone like Leland Yee, who has been around longer, has statewide fundraising capability and brought in a huge war chest for his last Senate race. Without public financing, the race would come down to a small number of candidates; the voters would have fewer choices. The current system opens the election to a wider and more diverse group of candidates — that was the whole idea.


Same goes for RCV. Under the old system, some would be arguing that with three Asians in the race —  Yee, Chiu and Phil Ting — the Asian votes would be split and diluted and none of the three would win. With RCV, the opposite’s likely to happen — three Asian candidates means more Asian voter interest, and all three candidates benefit from that.


There may be more candidates; nothing wrong with that. Except that the San Francisco Chronicle doesn’t seem to like democracy.


 



Delta fish may not be “too far gone” after all

The San Francisco Chronicle had this dire environmental pronouncement on its front page last week: “Delta fish may be too far gone to save, plan hints.”

Summarizing a report released by the Delta Stewardship Council, the article suggested that California’s salmon and Delta smelt — a delicate creature that’s sort of an aquatic equivalent to a canary in a coal mine — might be going the way of the dodo due to longterm environmental impacts. Even worse, it didn’t sound as if there was anything conservationists, state agencies, nor anyone else could do about it.

Aside from being downright depressing, that narrative sounded a little, er, fishy. No one disputes that the Delta has been dramatically impacted by environmental problems, and concerns about diminishing fish populations are well founded. Fights over pumping freshwater out of the Delta have been dragging on for years, pitting environmentalists and commercial fishermen against powerful water districts in arid regions.


But the notion that there’s no longer any point in trying to save these Delta fish seemed hard to swallow. To take a cynical view, it would be rather convenient for certain powerful interests if the time, money, and water dedicated toward saving the salmon and smelt were freed up for other purposes.

Not being experts ourselves, however, we phoned Zeke Grader, who really knows his fish. Grader is the executive director of the Pacific Coast Federation of Fisherman’s Associations, a San Francisco-based trade association that represents commercial fishermen from Alaska to San Diego. Grader told us he was unwilling to accept the idea that it’s too late to save the salmon and the smelt.

“There may be some species … that are so far gone that it’s going to be impossible to save them, but I don’t think that’s the case with the salmon,” he said.

For once, Grader had some good news about the dramatically impacted salmon population. “This year, we had returns for the first time in 60 years upstream of the San Joaquin, now that we’ve got water back in it,” he said, referring to federally mandated increases in freshwater pumping into the Delta in recent years. “That clearly shows that after a couple years of restoring fish flows to it, that we’re getting fish back. That’s very encouraging, and we still have a lot to do, but I think we are going to be able to save the salmon.”

It might not be too late for the smelt, either, in Grader’s view. “I think we can save the Delta smelt. I think what was being said in the Delta Stewardship Council report has been either misinterpreted or misreported, because that’s simply not the case,” he added. “Maybe this is something that the water guys would like to create that myth, that well, we can’t restore, therefore don’t protect them — which is utter nonsense.”

Grader attributed the improvements to programs that truck fish around the Delta in an effort to avoid water pumps, which can fatally impact salmon, as well as increased freshwater flows.

He added that he didn’t see how the Delta Stewardship Council could proceed with a plan working with the assumption that extinction of certain species is inevitable. “Unless they just decided to ignore the Clean Water Act, ignore the Endangered Species Act, ignore … all of our water laws, I don’t see why there’s any reason that we can’t recover a lot of these,” he said.

No more San Brunos!

For decades, the Guardian has done story after story on PG&E’s deteriorating service, terrible maintenance record, continuous stonewalling and coverups, emphasis — not on safety — but on jacking up executive salaries and putting tens of millions into fighting community choice aggregation in San Francisco and Marin, and on the granddaddy of monopoly moves (last year’s Prop 16). The San Francisco Chronicle, to its immense credit, has come through with a series of stories laying out PG&E’s virtually criminal behavior in the San Bruno pipeline explosion.

Now TURN, the consumer watchdog over utilities, is putting forth an excellent way to fight back with a  tough petition and spreading the word. TURN says, “PG&E charged its customers $5 million to fix a gas pipeline under San Bruno in 2009, but delayed the work citing other priorities. The company then spent $5 million on executive bonuses.”

Take action to demand PG&E make customer safety its top priority, and pay for the costs of this tragedy with its own profits, not our pockets.

Early indicators

Land use politics and the way development decisions are made at City Hall fed San Francisco’s ascendant progressive movement over the last decade. So in the wake of a still-unfolding political realignment, an early key vote is making some preservationists and developer foes nervous.

At the center of that concern is Sup. Jane Kim, who broke with her progressive colleagues Jan. 25 to be the swing vote in the board’s 6-5 approval of attorney Richard Johns to the historian’s seat on the Historic Preservation Commission. Progressives and preservationists opposed the nomination on the grounds that Johns isn’t a historian and that he has close ties to former Mayor Willie Brown, a friend of developers whose longtime chief of staff was Johns’ wife, Eleanor.

And they’re suspicious of Brown’s support – both overt and stealthy – for Kim’s supervisorial campaign (see “Willie Brown and the accusations of machine politics in D6,” 10/16/10, Guardian Politics blog).

Kim didn’t explain her vote at the full board meeting, and her comments at the Rules Committee (which she chairs) and to the Guardian that Johns “was qualified” and she could “see no reason not to support his nomination” irked many of her progressive supporters who consider development the big issue.

Feeding concerns about the potential blunting of historic preservation and other tools used to scrutinize development projects was the Jan. 25 announcement by Sup. Scott Wiener that he is calling for hearings into whether the commission is improperly hindering development and other policy priorities.

“The Historic Preservation Commission — and I supported the creation of the Historic Preservation Commission — has become an increasingly powerful commission reaching into a lot of different areas of policy in the city,” Wiener said during the discussion of Johns’ nomination, citing housing, parks, and libraries as areas the commission has affected. “It’s important to have a diversity of backgrounds and viewpoints on this commission, and if we’re going to have a committee made up exclusively of advocates for historic preservation, only advocates, that is a problem.”

Former board President Aaron Peskin, who led the effort to create the commission through the voter-approved Proposition J in 2008, disputes the allegation that the commission has become too powerful, as well as the claim that Johns is qualified to serve in the historian’s seat, one of six seats on the commission that now requires professional qualifications.

“The facts do not support Sup. Wiener’s allegations,” Peskin told us, noting that the Board of Supervisors and the mayor retain the authority to decide what is and isn’t historically significant. Yet Wiener said that even commission- and staff-level actions affect other city goals. “The conducting of a survey does have legal impact,” Wiener told us.

But Peskin said San Francisco has very few protected buildings compared with other major U.S. cities, something voters sought to change through Prop. J, and Peskin said he was disappointed that Kim didn’t support the law’s dictates. “This is the second time in 2011 when the slim alleged progressive majority has not stayed together,” he said, referring also to the election of David Chiu as board president.

Peskin and others who fight land-use battles say they don’t yet want to jump to the conclusion that developers might have an easier time with this board. “It’s my profound hope is that this is a learning experience,” Peskin said of Kim’s vote.

Veteran land use attorney Sue Hestor noted that neither Kim nor Wiener has a record on land use issues by which to judge them and she didn’t want to make a big deal of their Jan. 25 actions. Yet she said that development is a huge issue in the Tenderloin, SoMa, and Rincon Hill areas that Kim represents, so there are major tests of her progressive values coming soon.

“In District 6, it’s the defining issue because it’s the most explosive district in terms of growth,” Hestor said. “Land use is about who gets to live in the city.”

 

WHOSE CITY?

While most of the discussion about the Johns nomination focused on his qualifications as a historian — indeed, that was the basis of most of the opposition to his nomination, by both activists and progressive supervisors — there was some telling subtext focused on Hestor’s point that land use is the most fundamental progressive issue.

At the Jan. 20 Rules Committee meeting, Kim even asked Johns about his “vision for affordable housing as it related to preservation.” But the answer she received wasn’t terribly reassuring to those who see the lack of affordable housing for low-income city residents as a serious problem that the city is failing to address (see “Dollars or sense?” 9/29/10).

“San Francisco is made up of lots of different groups of people with lots of different backgrounds,” Johns said at the hearing, noting that it is important to “preserve the culture and the past that have brought us to where we are. But part of that past is the ability to grow.”

In an interview with the Guardian, Johns expanded on the point, sounding a more pro-growth point-of-view than many of his colleagues on the commission are likely to share. “Development and preservation can go hand-in-hand,” Johns said. “Maybe it’s the development that allows what might be a slowly deteriorating building to be fixed up properly.”

As an example, he cited his 20 years of work on preserving the Old Mint Building — his main claim to expertise as a historian — which was ultimately accomplished as part of the development project that included office and commercial development and the Mint Plaza public space.

“People of all income levels have a right to live in San Francisco,” Johns said, adding, “The real need some people would say is the need for middle class housing.” When we noted that it’s often the low-income residents who are ousted when old buildings get modernized, he said, “You have to think about the desirability of people to live in crummy housing.”

Chiu and Kim both downplayed the importance of the Johns vote. “People are trying to read too much into this,” Chiu said, explaining that he opposed the nomination because he simply felt Johns didn’t meet the criteria as a historian. “What was relevant is what city law says.”

Kim told us that it wasn’t until the full board meeting that she learned how her progressive colleagues felt about the matter, and that she didn’t want to change how she voted in committee. “It was not important enough for me to change my vote based on my verbal commitments,” Kim said later.

Yet on the evening of the vote, Kim told the Guardian that she felt “pressure” to support Johns, although she wouldn’t say from whom. “I was put in a bad position on this issue,” she said. Many progressives have speculated that pressure came from Brown, which Kim denies. “We didn’t talk about this, not once,” she said.

But in his Jan. 30 column in the San Francisco Chronicle, Brown crowed about the victory by “my friend Richard Johns” and called Chiu’s opposition to him “a mistake that could haunt him for some time,” saying Chiu has set up Sups. Malia Cohen and Kim “to be the swing votes on every issue where moderates and progressives split.”

John Ross dies at 72

When John Ross left Terminal Island, the federal prison in Los Angeles, after serving a couple of years for refusing the Vietnam draft, the warden shook his head and said: “Ross, you never learned how to be a prisoner.”


I’m not writing the epitaph for whatever gravestone he has or doesn’t have, wherever it might be in the world, but that’s what I’d put on it: “John Ross, 1938-2011. Never learned how to be a prisoner.”


John, who died over the weekend, was a poet, author, activist, agitator and uncontrollable shit disturber, utterly and sometimes insanely fearless, pure of heart and devoted to the cause of social justice so deeply that he could never let up, even for a minute. He was also my friend.


John was a tenant organizer in San Francisco in the 1960s. He ran for supervisor once on a platform of rent control and ending the war; he was kicked off the ballot on the basis that he was a convicted felon. He never got his filing fee back.


After a while, he headed north for Arcata, back to the land, so to speak, and became something of a farmer. He wrote poetry, self-published maybe half a dozen books, most of which I have, some of which are probably lost forever. He wrote freelance for the Guardian, but he had no phone; you’d call him at a bar in Arcata (he swore later that Thomas Pynchon was one of his barmates), leave a message and he’d check in when he got it.


Then in 1984, he showed up at our office in San Francisco, fleeing the Campaign Against Marijuana Planting, which had raided his plot, trashed his house, thrown his typewriter out the window and missed capturing him by a few minutes. He sold the last of the crop in the city, found a room and started writing for us regularly.


He was one of the single most talented writers I’ve ever met — and a reporter willing to go anywhere for a story. He was also an absolute pain in the ass to work with. Every John Ross story I ever edited was a nightmare. He hated editors, almost as a matter of religion; every single word was sacred, and anytime I tried to mess with what he’d created he’d threaten to quit. “Take my name off the masthead; I’m never working for you again” was almost a mantra with us. It got to the point where I had to say: No, John. You can’t quit. You’re part of this operation forever, like it or not. And he always came around.


But it’s not a surprise that he never held down a real job for long.


Sandy Close at Pacific News Service sent him to Mexico City after the big earthquake in 1985, and he wound up at the Hotel Isabel, where he lived for the next 25 years. He took on stories nobody else would do or could do; he’d go places nobody else would dare. “Tim,” he’d always tell me, “you have to go where the story is.”


When the Zapatistas began their rebellion, he hitched a ride south from Mexico City, then hiked into the hills in Chiapas with a bag of granola and a couple of bottles of water, found the rebels in a little hamlet, met Subcommander Marcos and got interviews and information that left the rest of the media in the dust. In the first story he sent me, he described seeing a couple of reporters from the San Francisco Chronicle zipping by in a fancy rented jeep, with about $1,000 worth of camera gear, totally befuddled. They were out of their league; John was right at home.


He called me once, late at night, to ask if I knew any doctors in town. Turns out he’d been beaten pretty badly by the Mexican authorities just before getting on a plane to SF. I asked him how it happened, and he told me that he’d decided, on his own, to stand in the Mexico City airport and make a speech denouncing the government. The cops didn’t respond kindly.


He went to Iraq before the war to serve as a human shield in Baghdad (his emails were all signed “John Ross, humanshield”), left after having some clashes (imagine that) with his Iraqi government minders, travelled all over the world writing and selling his books, sent me pieces from everywhere, lost his eye to an old injury from fighting with the SFPD (his email signature became “Juan Eye”), won and refused an award from the City of San Francisco, wrote a major investigative piece on the death of journalist Brad Will and kept writing until the very end. When he was diagnosed with terminal liver cancer, he started signing his emails “John Ross, not dead yet.”


The last message I got was on Nov. 4. After complaining some more about the cops, he wrote:


“it appears ive written my last articles for the bay guardian — the doctors have given me six months on the outside and then its goodbye this cruel world — we raised some hell when i was here.” It’s signed: “insolidarity johnross enroute.”


Yes, John: We raised some some hell when you were here. Good luck enroute. And I will miss you forever.


John Ross leaves a son, Dante A. Ross, a daughter, Carla Ross-Allen, and a granddaughter, Zoe Ross-Allen, as well as a stepdaughter, Dylan Melbourne and her daugther Honore, as well as a sister, Susan Gardner. Memorial info is pending; I’ll keep you posted.

CAREERS AND ED When the University of California Board of Regents met Nov. 17, 2010 to approve an 8 percent tuition hike, roughly 300 UC students who were furious about the decision converged outside the University of California, San Francisco (UCSF) campus at Mission Bay to rally in opposition, some traveling from as far away as Los Angeles.

“We had been organizing with all the campuses to get students to come up because we really wanted to be there to let them know that it’s not what we want, and it’s something they can’t just get away with doing year after year,” said UC Student Association President Claudia Magana. The protests were raucous, and police cracked down by discharging pepper spray and making 13 arrests.

Despite the palpable fury outside and impassioned student opposition delivered to the Regents inside, the 8 percent fee increase was approved. It came on the heels of a 32 percent tuition increase imposed the year before, and the price was ratcheted up by 9 percent and 7 percent in the years prior to that.

The tuition hikes were steep, but hardly new. Indeed, the cost of attending UC schools has been rising steadily for quite a while. According to a study by economist Peter Donohue, student tuition and fees increased 277 percent from 1990-91 to 2008-09, and that was prior to the 40 percent increase that followed. That trend is repeated in rising costs at the California State University and California Community College systems (See “Access Denied,” April 6, 2010).

Student protesters have sought to make it clear that their outrage isn’t rooted in selfish unwillingness to shell out more money, but instead is linked to a broader concern about privatization and the increasingly limited accessibility of public education.

Magana expressed concern that the climbing cost of instruction at UC, though still a relative bargain compared with private institutions, would ultimately start to affect who could and couldn’t attain higher education through the public university system. The question isn’t limited to UC — tuition is increasing at public and private colleges across the board, and as income inequality sharpens, more students seek higher education.

“Students will always pay to be here,” she noted. “The issue is going to be, which students are here? That’s really the big problem — the huge class issue that’s going to come up. Although there are some forms of support for low-income students, it’s not easy.”

 

DEEPER IN DEBT

Rising costs at UC mirror the upward trend at private nonprofit and for-profit postsecondary institutions nationwide, and those higher prices have triggered a dramatic increase in student borrowing. While students from low- or medium-income families can access higher education at any institution they’re admitted to as long as they’re willing to take out significant sums in student loans, many find themselves at a serious disadvantage once they have to start repaying their debt.

A study conducted by the Public Interest Research Group (PIRG) noted that hefty debt burdens often dissuade graduates from pursuing careers in teaching, social work, the nonprofit sector, or other low-paying occupations that foster social justice. PIRG found that 23 percent of public four-year college grads and 38 percent of private four-year college grads were saddled with too much debt to manage paying back student loans on a starting teacher’s salary.

For students pursuing careers as social workers, the economic bind looked even worse: 37 percent of public school grads and 55 percent of private school grads with student loans wouldn’t be able to manage repayment with starting salaries in that field, the study concluded.

“Because students with lower incomes are more dependent on student loans than higher income students, students who already face significant challenges to attending college will more strongly feel the effect of loan debt on career choice,” the report points out.

“It’s a serious problem for so many young people to be starting out their working life so deep in debt,” said Edie Irons, spokesperson for The Institute on College Access and Success (TICAS), an Oakland-based research organization. “It really does limit people’s ability to take advantage of the opportunities education is supposed to provide. In concrete terms, it can make it really hard to buy a house, or start a business, or start a family, or go back to grad school, or to save for retirement or your own children’s education. And that’s all assuming you can keep up with the payments.”

Student loan debt has intensified over the past two decades. In 1993, just one third of all four-year college students graduated with debt, owing on average slightly more than $9,000, according to PIRG.

Today, the majority of college students take out loans to finance their education. Around 62 percent of public university students graduate with student loans, as do 72 percent of students attending private nonprofit institutions, and 96 percent of students attending for-profit institutions such as the University of Phoenix or the Academy of Art University, according to TICAS. Nationally, students graduate owing an average of $24,000, not counting debt associated with advanced degrees.

While young people must invest more than ever before to obtain higher education, the return on investment isn’t showing signs of improvement. The expected median income for UC graduates has stayed the same over the last decade, even as the cost of tuition has ballooned.

What’s more, says Bob Meister, president of the Council of UC Faculty Associations and professor of Political and Social Thought at UC Santa Cruz, is that an estimated 40 percent of public university students entering the workforce will either be unable to find a job, or will land in a lower-paying job that doesn’t require a college degree.

“For college graduates under 25, the unemployment rate is nearly as high as the national unemployment rate,” around 10 percent, Meister notes. “Over the past decade, what’s happened is that the median hasn’t risen. The top has risen very fast, and the bottom has fallen.”

 

IN A DIFFERENT CLASS

There’s no doubt that diminished state funding is affecting California’s public universities.

“A lot of departments are being eliminated, and a lot of professors who are really amazing are leaving to other universities,” Magana says. “And the waiting lists for classes are just ridiculous.” Academic goals are being compromised — for example, students had to abandon their push for an ethnic studies program at UCSC, she added, because the American studies department that would have partially supported it was slashed.

While diminished public funding has been used to explain the need to raise tuition, Meister has published numerous essays suggesting that the root cause of rising tuition costs at UC goes deeper than that, and he has gone so far as to publicly encourage students not to accept higher tuition without first demanding financial information.

Meister previously served on the UC budget committee and has observed the institution’s evolving financial policies for years. He doesn’t seem surprised that tuition is going up, regardless of what condition the economy is in or what amount of public funding is available because, as he puts it, “the universities will cost as much as they can.” UC had long sought to boost revenue by raising tuition, he noted, yet its leaders feared a rollback in state funding in response. But that changed under Gov. Arnold Schwarzenegger, who agreed to increase state support only on condition of that UC in turn require students to contribute more.

Around the same time that Schwarzenegger provided this new incentive to raise tuition, UC pooled its various revenue streams into a consolidated general revenue fund, Meister said, a departure from the old way of keeping separate accounts. This new fund, which included all non-state revenue and funding that wasn’t legally required to be used for certain purposes, could be pledged entirely as collateral for bonds for new construction projects, greatly increasing the institution’s borrowing power and boosting its revenue with the addition of new facilities.

To maintain its stellar bond rating, UC had to ensure an increase in revenues, according to Meister’s explanation, and to do that, UC ratcheted up the one source of revenue it had full control over: tuition. Meister laid bare this financial play in a 2009 open letter to students, titled “They Pledged Your Tuition.” Since it was published, a small corps of student activists has become deeply engaged in studying campus finance documents and airing criticism of financial policies.

Just before the Nov. 17 protests at UCSF Mission Bay, Meister published another open letter, this one addressed to UC President Mark Yudof. This one contemplated, “Why they think they can increase revenues regardless of how fast the economy grows … and regardless of whether the income of graduates is stagnant.”

His answer is somewhat surprising: “Their ability to raise tuition is a function of the growth of income inequality,” he told the Guardian. In the letter, Meister charges, “In the 21st century, when almost all income growth has been in the top 1 to 2 percent of California’s population, UC is still marketing income inequality to students as its most important product. It now expects all students to pay more for an ever-shrinking chance of reaping the ever-growing rewards that our economy makes available to the few. Your plan to increase revenue through tuition growth is feasible, of course, only because the federal government still allows students to borrow more for education despite the greater likelihood that they will not be able to repay — student loans may be the last form of subprime credit available in our economy.”

His theory highlights a paradox. “Being in the have-not category is increasingly worse,” he explains, “and so they are willing to take on more debt, which actually dampens their prospects for income growth.”

The question now is what will happen under Gov. Jerry Brown, who is likely to take a different stance toward rising tuition than Schwarzenegger but nonetheless is expected to unveil harsh cuts to education as a way to address a $26 billion budget deficit.

In a recent interview with the San Francisco Chronicle, UC Regent Richard Blum indicated that it probably would not be feasible to raise tuition again, so the message was that students should brace for more cuts to education.

When Brown unveiled his proposed budget on Jan. 10, he announced further cuts to higher education in California to balance the state budget. Brown’s revised 2010-11 budget decreases the state funding for UC, CSU, the community college system, and other higher education programs by $1.7 billion for the 2011-12 budget. The UC system would take a 13.3 percent hit in general fund support; the proposed cut to the CSU system is 12.5 percent; and the community college system would be cut by 6.9 percent.

Brown, who also wants to hold a special election to ask voters to maintain the current level of tax rates for income, sales, and vehicle license taxes for five years rather than let them expire later this year, expressed regret about making cuts to higher education. But he emphasized the need to make tough decisions in the face of a bleak financial outlook, saying, “We need to face the music.”

Out at the west end of Haight Street, what do we find? Not a pot of gold, sadly, though plenty of pot, whose haze hovers fragrantly above the pavement like hippie ground fog. Also: a McDonald’s, complete with parking lot. This has always faintly depressed me. Across the street, an emerging Whole Foods (with parking lot), while a block to the east, the old I-Beam has been obliterated in favor of condos.

In the midst of all this corporate commotion, it would be easy to overlook Parada 22, a tiny restaurant that opened last spring serving Puerto Rican food. The western run of Haight Street, while rich in places to eat, has never really been known for its restaurants, yet Parada 22 is worth seeking out. If I hesitate to describe it as a destination restaurant, it’s only because that label might raise expectations to curse (in the sense of “hex”) level.

We are talking, after all, about a restaurant with concrete floors, crayon drawings, and old newsprint on the walls (including the San Francisco Chronicle’s unforgettable reporting on the outbreak of the Spanish-American War), no host’s station, and a table set just inches from the front door, the better for the people seated at it to be buffeted by winter drafts as diners come and go.

But we look closer and find grace notes. Each table holds a flickering candle, along with an old coffee can supplied with utensils and napkins. Even better: one of the chefs, on a cold evening, brings everyone a little cup of pork and vegetable soup, made from a pork leg roasted earlier in the day (and with stock made from the roasted bones). You might call this an amuse-bouche — if it was more whimsical and less sustaining. I warmed my hands with the cup, since concrete floors can make a place seem cold even if it isn’t.

Puerto Rican cooking involves versions of and variations on foods that are characteristic of the Caribbean basin. It’s on the rustic side, with plenty of beans and rice, roasted plantains, and cassava root (an appealing alternative to the potato that has never found much traction in our own potato-involved cuisine). The root stars in a salad ($7) that, when warmed, provides a strong contrast to the chilled greens, carrot tabs, and tomato dice. (The advertised avocado was a no-show.)

There’s also plenty of meat, at least as Parada 22’s kitchen prepares the cuisine, with an emphasis on pork. Pork’s cultural meaning is complex; pigs are fecund scavengers that thrive across a wide range of habitats, which means they are efficient producers of protein and therefore a boon to human populations in less than bountiful circumstances. And pork, along with wine, is about as closely associated as a comestible could be with Latin Christianity. Eating it — or not eating it — can be a powerful assertion of cultural identity.

I love pork as a cook would love it, for its compatibility with so many different treatments and seasonings, its modest cost, and its relative ease of handling. Parada 22’s pernil asado ($12), which reached the table as a heap of oval slices, reminded me of how good pork can be even when lightly adorned (with garlic and oregano) and simply roasted: the meat juicy and giving a hint of ropiness for texture. As, perhaps, an echo of humankind’s ancient fear of going hungry, the plate was finished with failsafe heaps of Spanish rice (studded with bits of ham), white beans (simmered with potato, carrot, and winter squash), and a green salad. Even without the pork, there would have been a meal.

Just as meal-worthy was a pot of red beans ($3.50) simmered in a spicy red sauce with bits of ham and chunks of cassava root. If you had only a fiver in your pocket, you could go to the McDonald’s a few blocks away and end up with God knows what, or you could have Parada 22’s red beans — a stew, really — and be much more genuinely nourished.

The menu card also offers several sandwiches, including a Cuban version with pork (Puerto Rican and Cuban foods seem much more alike than not) and a beef edition ($9), with mats of meat whose toughness belied their thinness. Caramelized onion and melted white cheese lent a Philly-cheesesteak effect. The baguette was adequate, but the whole thing would have been better if the bread had been toasted.

For dessert there was, fittingly, rum cake ($3.25), a neat square of yellow sponginess under a cap of whipped cream. It looked quite demure and innocent but did have DUI alcohol breath. In that respect, it reminded me of tiramisù, except much less soggy and therefore more coherent. Bust averted.

Spoiled mayor wants to get his way

I guess it’s no surprise that Gavin Newsom takes his political cues from the San Francisco Chronicle editorial board. But this spoiled-kid choose-a-mayor-I-like-or-I-won’t-leave attitude isn’t pretty. Newsom has chosen a new office; it’s no longer his business who the folks he left behind want to put in Room 200.


And here’s what’s silly: If he wants a caretaker mayor, he’s not helping things with this approach. I actually think the incoming board is less likely to pick a caretaker. And the overall political leaning of the new board isn’t that different than the current board.


Newsom even seemed to acknowledge that: “I wonder what the big difference is now the more I work through the math.”


So why exactly is he doing this? Just to make the Chron folks feel important? Just to leave us with one last show of petulance? Or has he cut some sort of deal with the incoming supervisors? And which candidate does he want, anyway? because if it’s Ed Harrington, I hope he’s worked through the math — there’s no way Harrington gets six votes on the new board, unless either David Chiu or Jane Kim goes totally south and decides to support a pro-PG&E candidate who will only continue the worst of Newsom’s policies.


Frankly, I don’t see it happening.


Gavin: You’re done. You can’t choose the next mayor; you don’t have the votes. So quit whining and move on.


 




 


 


 


 


 


 

Class conflict in DC and SF

There’s an unmistakable whiff of class warfare in the air this holiday season, most obviously on the national level where President Barack Obama and congressional Republicans are helping the ultra-rich steal hundreds of billions of dollars from future generations and the country’s current needs. But we’re also seeing it right here in San Francisco, subtly playing out around who will be our next mayor.

During yesterday’s scheduled discussion at the Board of Supervisors on choosing a new mayor, members of the public – from African-American mothers of slain youth to representatives of immigrant communities to those representing labor and progressive groups – urged the board to choose a mayor who would finally represent all of San Francisco, not just the wealthy and the business community.

Then the progressive supervisors who represent the city’s working class districts talked about getting the process underway and voiced some of the things they’d like to see in a new mayor, such as compassion and a willingness to work with the board and community groups. It seemed like a good faith effort at having an open public discussion about the city’s needs.

But on the other side of the aisle, the supervisors who represent the city’s wealthiest neighborhoods voted to delay the discussion without offering a reason why. Sup. Chris Daly made good points about how incoming mayors usually have time to prepare for assuming this powerful office at a time of pressing city needs and tricky political dynamics, arguing for making this decision sooner than later.

And from the Establishment representatives: nothing. Not a word. Instead, we have Mayor Gavin Newsom threatening to delay his swearing in as lieutenant governor to thwart the current board from picking a successor, and being overtly urged to do so in a San Francisco Chronicle editorial and in disingenous, sanctimonious ruses from SF Chamber of Commerce officials.

Why? Well, here’s the closest thing the editorial offered to a reason: “It makes all the sense in the world to have the supervisors who will be working with the interim mayor make the selection. They are the ones who will have to find common ground and develop a working relationship with Newsom’s successor.”

But does it really make any sense to have an inexperienced group of new supervisors (as our current cover stories shows, none of the four new supervisors have held municipal office and two are new to politics) pick a mayor on their first day on the job, and then have that person immediately take on the complicated job of running the city with no staff in place? And to do that by flouting the the California Constitution and the City Charter?

That sounds like a recipe for disaster – and an opportunity for downtown power brokers to make mischief and ensure their interests aren’t threatened as part of whatever backroom deal gets cut to choose a new mayor, district attorney, and board president. Why else would they so vehemently oppose a deliberative public process that would lead to a decision by those who know the workings of City Hall better than anyone?

As we saw in the last election, wealthy San Franciscans are scared to death of progressive malcontents like Chris Daly, and they’re doing whatever they can to prevent him from being involved in this decision. They see, probably correctly, that the current political dynamics of the city could lead to perhaps the most progressive mayor since George Moscone, or maybe ever, and they’ll do whatever they can to prevent that from happening.

The rich of this city and this country have overplayed their hands, crippled the public sector, and, as Sen. Bernie Sanders so eloquently said recently on the floor of the US Senate, shown a selfish disregard for the needs and interests of the vast majority of citizens. The only question now is this: are we ready to finally stand up, fight back, and really give them something to fear? Or are we going to take our cues from Obama and treat anti-government conservatives as good faith actors when they have shown only contempt for our most cherished democratic processes and values?

I suppose next week, when this board reconvenes to try to choose a successor mayor, we’ll find out.

In the grand scheme of things — the $400 million budget deficit, the pending selection of a new mayor, that sort of thing — the eviction of the Haight Ashbury Neighborhood Council Recycling Center doesn’t sound like an earthshaking issue. The San Francisco Chronicle’s C.W. Nevius (who is pretty much on the wrong side of everything these days) proclaimed last week that it was just a little neighborhood tiff, nothing to do with the soul of the city.

But it annoys me as much as anything that’s happened this fall — and it says a lot about the way Gavin Newsom governs San Francisco and explains why so many of us will be so happy when he leaves town.

Let me come right out and say it: the HANC eviction is class warfare. It’s not about the appropriate use of park land or the need for a community garden. It’s about the fact that the mayor doesn’t like poor people trundling through an upscale part of town with shopping carts full of recycling.

Let me quote what Rebecca Bowe wrote in a blog post at sfbg.com:

“In its current function, the HANC Recycling Center is empowering to many different kinds of people. Most aren’t homeless. Tough-as-nails Asian grandmas show up with bags full of cans that they can exchange for some extra spending money. Urban gardeners purchase native plants in hopes of pleasing native insects and birds. People on fixed incomes get a small financial boost by turning in recyclables.

“A small number of HANC Recycling Center patrons do sleep outside. In order to earn small amounts of cash for things like food, many of them have to go digging around in garbage cans, which is gross and humiliating. Why would someone paw through the garbage for hours, battling bees and germs, and then haul smelly bottles uphill in a shopping cart just to make a few bucks? My guess is that it’s to ward off desperation. They make their own work and they get to eat.”

Let me focus on that last sentence for a second. As my friend Tiny at Poor Magazine likes to point out, being poor or homeless is a lot of work. Collecting cans, cashing them in, finding a way to survive on that minuscule income … it’s not easy. It takes as much effort and as many hours as most traditional full-time occupations.

But Newsom doesn’t want poor people in his city. He doesn’t want anyone bothering the wealthy. And he doesn’t care about facts or the public sentiment.

City residents — those folks Nevius and Newsom love to celebrate — showed up in large numbers at the Recreation and Park Commission to oppose the closure. There’s no logic to it at all; the center pays rent and creates jobs. The community gardens will cost money — and in the shade (where the center is located), it will be hard to grow much produce.

But never mind: Newsom got what he wanted. A city that will spend millions in public money on yacht races while making life on the streets that much meaner. Good riddance, Gav.

Chronicle employees told to accept “substandard” contract

After some tough talk about resisting a “substandard offer” from San Francisco Chronicle management, the California Media Workers Guild has decided to urge Chronicle workers to approve a new contract offer that is “essentially the same company proposal” that workers resoundingly rejected just last month. The vote is set for Dec. 13.

Guild representative and longtime Chronicle writer Carl Hall told the Guardian last week that “they basically stiff-armed us” and “refused to negotiate any compromise since October” in contract talks. “We see it as insulting, irresponsible corporate behavior given everything staff has done,” Hall told the Guardian last week.

He told us workers planned to rally against the Chronicle and enlist the help of the community, readers, and local labor leaders. “The company is just not listening, so we’re going to have to get a louder voice to achieve that.” The Guild’s campaign included online testimonials from various Chronicle employees, including conservative columnist Debra Saunders, who began her missive by writing, “I am probably the last person Chronicle readers would expect to see standing up for a union.”

But since then, the Guild has essentially capitulated to management’s demand for a status quo contract, arguing that it’s the best they can get for now despite the 106-29 vote against that contract. “Since then, however, the economy has deteriorated even further, and other media companies in the Bay Area have announced fresh concession demands. At the Chronicle, many Guild members said they were ready to fight, but most recognized it would take some months to build up a potent campaign and public support,” the Guild wrote in a statement on its website. “Given those circumstances, the commitee decided it would be better to accept the current proposed changes — and continue mobilizing in advance of the next round of talks.”

Guardian calls to the Chronicle’s Publisher’s Office were not returned.

The biggest fish

Shortly after Larry Ellison, the billionaire CEO of Oracle Corp. and owner of the BMW Oracle Racing Team, won the 33rd America’s Cup off the coast of Valencia, Spain, in February 2010, a reception was held in his honor in the rotunda at San Francisco City Hall.

The event drew members of Ellison’s sailing crew, business and political heavyweights such as former Secretary of State George Schultz, and other VIPs. Attendees posed for photographs with the tall, glittering silver trophy at the base of the grand staircase.

As part of the celebration, Ellison helped Mayor Gavin Newsom into an official BMW Oracle Racing Team jacket, and Newsom granted Ellison a key to the city, a symbolic honor usually reserved for heads of state and the San Francisco Giants after they won the World Series. Shortly after, the mayor and the guest of honor, whom Forbes magazine ranked as the sixth-richest person in the world, sat down for a face-to-face.

That meeting marked the beginning of the city’s bid to host the 34th America’s Cup in San Francisco in 2013. Since securing the Cup, Ellison has made no secret of his desire to stage the 159-year-old sailing match against the iconic backdrop of the San Francisco Bay, a natural amphitheater that could be ringed with spectators gathered ashore while media images of the stunningly expensive yachts are broadcast internationally.

Newsom and other elected officials have feverishly championed the idea, touting it as an opportunity for a boost to the region’s anemic economy. The city’s Budget & Legislative Analyst projects roughly $1.2 billion in economic activity associated with the event — the real prize, as far as business interests are concerned. It would also create the equivalent of 8,840 jobs, mostly in the form of overtime for city workers and short-term gigs for the private sector.

While the idea has won preliminary support from most members of the Board of Supervisors, serious questions are beginning to arise as the finer details of the agreement emerge and the date for a final decision draws near.

Ellison and the race organizers would be granted control of 35 acres of prime waterfront property in exchange for selecting San Francisco as the venue for the Cup and investing $150 million into Port of San Francisco infrastructure. But the event would result in a negative net impact to city coffers.

Hosting the event and meeting Ellison’s demands for property would cost the city about $128 million, according the Budget & Legislative Analyst, just as city leaders grapple with closing a projected $712 million deficit in the budget cycle spanning 2011 and 2012.

Part of the impact is an estimated $86 million in lost revenue associated with rent-free leases the city would enter into with Ellison’s LLC, the America’s Cup Event Authority (ACEA). In exchange for selecting San Francisco as a venue and investing in port infrastructure, ACEA would win long-term control of Piers 30-32, Pier 50, and Seawall Lot 330 — waterfront real estate owned by the Port of San Francisco, with development rights included. Seawall Lot 330, a 2.5-acre triangular parcel bordered by the Embarcadero at the base of Bryant Street, would either be leased long-term or transferred outright to ACEA.

The most vociferous opponent of the America’s Cup plan is Sup. Chris Daly, who has voiced scathing criticism of the notion that the city would subsidize a billionaire’s yacht race at a time of fiscal instability. “The question is whether or not the package that San Francisco’s putting together is good or bad for the city,” Daly told the Guardian, “and whether or not it’s the best deal the city can get.”

 

THE CREW

According to a Forbes calculation from September 2010, Ellison’s net worth is $27 billion, making him several times wealthier than the City and County of San Francisco, which has a total annual budget of about $6 billion. Ellison reportedly spent $100 million and a decade pursuing the Cup.

As soon as Ellison expressed interest in bringing the Cup to San Francisco, Newsom began charting a course. Park Merced architect and Newsom campaign contributor Craig Hartman of the firm Skidmore, Owings & Merrill was tapped to reimagine the piers south of the Bay Bridge as the central hub for the event, and soon Hartman’s vision for a viewing area beneath a whimsical sail-like canopy was forwarded to the media.

The mayor also issued letters of invitation to form the America’s Cup Organizing Committee (ACOC), a group that would be tasked with soliciting corporate funding for the event. ACOC was convened as a nonprofit corporation, and it’s a powerhouse of wealthy, politically connected, and influential members.

Hollywood mogul Steve Bing, who’s donated millions to the Democratic Party and funded former President Bill Clinton’s 2009 trip to North Korea to rescue two imprisoned American journalists, is on the committee. So is Tom Perkins, a Silicon Valley venture capitalist, billionaire, and former mega-yacht owner who was once dubbed “the Captain of Capitalism” by 60 Minutes. George Schultz and his wife, Charlotte, are members. Thomas J. Coates, a powerful San Francisco real estate investor who dumped $1 million into a 2008 California ballot initiative to eliminate rent control, also has a seat. Coates resurfaced in the November 2010 election when he poured $200,000 into local anti-progressive ballot measures and the campaigns of economically conservative supervisorial candidates.

Billionaire Warren Hellman, San Francisco socialite Dede Wilsey, and former Newsom press secretary Peter Ragone are also on ACOC. There are representatives from Wells Fargo, AT&T, and United Airlines. One ACOC member directs a real estate firm that generated $2.5 billion in revenue in 2009. Another is Martin Koffel, CEO of URS Corp., an energy industry heavyweight that made $9.2 billion in revenue in 2009. There’s Richard Kramlich, a cofounder of a Menlo Park venture capital firm that controls $11 billion in “committed capital.” And then there’s Mike Latham, CEO of iShares, which traffics in pooled investment funds worth about $509 billion, according to a BusinessWeek article.

There’s also an honorary branch of ACOC composed of elected officials including House Minority Leader Nancy Pelosi, Gov. Arnold Schwarzenegger, Sen. Dianne Feinstein, and others. Their role is to help the Cup interface with various governmental agencies to control air space, secure areas of the bay exclusively for the event, set up international broadcasts, and bring foreign crew members and fancy sailboats into the United States without a hassle from immigration authorities.

ACOC is expected to raise $270 million in corporate sponsorships for the America’s Cup. That money will be funneled into the budget for ACEA. It’s unclear whether the $150 million ACEA is required to invest in city piers will be derived from ACOC’s fund drive.

The city also anticipates that ACOC would raise $32 million to help defray municipal costs. “However,” the Budget & Legislative Analyst report cautions, “there is no guarantee that any of the anticipated $32 million in private contributions will be raised.”

A seven-member board, chaired by sports management executive Richard Worth, will direct the ACEA, according to Newsom’s economic advisors, but the other six seats have yet to be filled. ACEA’s newly minted CEO is Craig Thompson, a native Californian who previously worked with a governing body for the Olympics and has helped coordinate major sporting events internationally. In an interview with sports blog Valencia Sailing, Thompson provided some insight on why major corporations might be inspired to donate to the cause. Basically, the Cup is the holy grail of networking events.

“It’s a very difficult economic situation we are going through, and it’s not the best time to be looking for sponsors for a major event,” Thompson acknowledged. “On the other hand, the America’s Cup is one of the very few activities … that offer access to really top-level individuals in terms of education or economic situation. The America’s Cup is a unique platform for a lot of companies that want access to those individuals that are very difficult to reach under normal circumstances. I can tell you for example that Oracle is very pleased with the marketing opportunity the America’s Cup has presented to them. They invite their best customers and are very successful in turning the America’s Cup into a platform for generating business. The same thing can be true for a lot of different companies that need access to wealthy individuals.”

But should San Francisco taxpayers really be subsidizing a networking event for the some of the business world’s richest and most powerful players?

 

TRANSFORMING THE WATERFRONT

Over the past four months, Newsom’s Office of Economic and Workforce Development (OEWD) has been negotiating with race organizers to hash out a Host City Agreement outlining the terms of bringing the America’s Cup to San Francisco.

The proposal will go before the Board of Supervisor’s Budget & Finance Committee on Dec. 8, and to the full board Dec. 14. A final decision on whether San Francisco will host the race is expected by Dec. 31. ACEA and ACOC will each sign onto the agreement with the City and County of San Francisco.

From the beginning, the event was envisioned as “the twin transformation,” according to OEWD — the America’s Cup would be transformed by attracting greater crowds and heightened commercial interest while San Francisco’s crumbling piers would be revitalized through ACEA’s $150 million investment in port infrastructure.

The plan paints downtown San Francisco as the “America’s Cup Village” during the sailing events, and a study produced by Beacon Economics estimates that the financial boost would come primarily from hordes of visitors flocking to the event — more than 500,000 are expected to attend. The city expects a minimum of 45 race days, including one pre regatta in 2011 and one in 2012 (or two in 2012 if the one in 2011 doesn’t happen), a challenger series in 2013, and a final match in 2013.

The transformation of the city’s waterfront would be dramatic. In addition to the rent-free leases for Piers 30-32, 50, and Seawall Lot 330, ACEA would be granted exclusive use of much of the central waterfront, water, and piers around Mission Bay, and water and land near Islais Creek during the course of the event. Under the Host City Agreement, race organizers would have use of water space spanning Piers 14 to 22 ½; Piers 28, 38, 40, 48, and 54, a portion of Seawall Lot 337, and Pier 80, where a temporary heliport would be sited.

Seawall Lot 330, a 2.5-acre parcel valued by the Port at $33 million, lies at the base of Bryant Street along the Embarcadero and has a nice unimpeded view of the bay. Piers 30-32 span 12.5 acres, and Pier 50 is 20 acres.

The Budget & Legislative Analyst’s study predicts that the ACEA could opt to build a 250-unit condo high-rise on Seawall Lot 330, deemed the most lucrative use. Under the Host City Agreement, the city would be obligated to remove Tidelands Trust provisions from Seawall Lot 330, which guarantee under state law that waterfront property is used for maritime functions or public benefit. Tweaking the law for a single deal would require approval from the State Lands Commission, but Newsom, in his new capacity as lieutenant governor, would cast one of the three votes on that body.

The combination of construction, demolition, lost rent revenue, police and transit, environmental analysis, and other event costs would hit the city with a bill totaling around $64 million, according to the Budget & Legislative Analyst study. Since city government would recoup around $22 million in revenue from hosting the Cup, the net impact would be around $42 million. That doesn’t include the potential $32 million assistance from ACOC.

At the same time, the city would stand to lose another $86.2 million by granting long-term development rights to 35 acres of Port property for 66 to 75 years without charging rent, bringing the total cost to $128 million. OEWD representatives played down that loss in potential revenue, saying past attempts to redevelop piers hadn’t been successful because none could handle the upfront investment to revitalize the crumbling piers.

The Host City Agreement has raised skepticism among Port staff and the Budget Analyst that tempered initial enthusiasm for the event. “The terms of the Host City Agreement will require significant city capital investment and will result in substantial lost revenue to the Port,” a Port study determined. Faith in that plan seems to be eroding and it may be scrapped for an alternative plan that’s cheaper for the city.

The Northern Waterfront alternative substitutes Piers 19-29 as the primary location for the event and eliminates the Mission Bay piers from the equation. Under this scenario, ACEA would invest an estimated $55 million, instead of $150 million. In exchange, it would receive long-term development rights to Piers 30-32 and Seawall 330 on “commercially reasonable terms,” according to a Port staff report.

Board of Supervisors President David Chiu requested that the Port explore that second option more fully, and the Port report notes that it would reduce the strain on Port revenue. The Northern Waterfront plan would cost the Port a total of $15.8 million, instead of $43 million, the report notes. Port staff recommended in its report that both the original agreement and the alternative be forwarded to the full board for consideration.

 

PHANTOM BIDS?

Under the competition’s official protocol, Ellison, as defender of the Cup, has unilateral power to decide where the next regatta will be held. Race organizers have said it’s a toss-up between San Francisco and an unnamed port in Italy — though it’s anyone’s guess how seriously a European site is being considered by a team headquartered at the Golden Gate Yacht Club, a stone’s throw from the Golden Gate Bridge.

According to a San Francisco Chronicle article published in early September, Newsom issued a memo stating that San Francisco was competing against Spain and Italy to become the chosen venue. Valencia was said to be offering a “generous financial bid,” and a group in Rome was rumored to have offered some $645 million to bring the Cup to Italian shores, the memo noted. It was a call for the city to present Ellison with the most attractive deal possible to compel him to pick San Francisco.

Speaking at an Oct. 4 Land Use Committee hearing, OEWD director Jennifer Matz told supervisors: “San Francisco was designated the only city under consideration back in July. Now we are competing against the prime minister of Italy and the king of Spain.”

However, the veracity of those claims came into question in mid-November. Daly, incensed that the Mayor’s Office never communicated with him about the Cup despite wanting to hold it in his sixth supervisorial district, launched his own personal investigation. He fired off an e-mail to Team Alinghi, a prior America’s Cup winner, and began communicating with other European contacts until he got in touch with someone in Valencia’s municipal government.

“I got a call back from a representative who basically said I should know something,” Daly recounted. Valencia, his source said, never submitted a bid to host the Cup. At a Nov. 13 press conference, Valencia’s mayor Rita Barbera confirmed this claim, according to a Spanish press report, expressing disappointment that the city had been eliminated from consideration as a host venue. “There was no formal bidding process,” she charged. She also denied reports that any money had been offered.

Meanwhile, the Budget Analyst was unable to find any concrete evidence that other host city bids had been submitted. “We have nothing to confirm that other offers have been made,” Fred Brousseau of the Budget Analyst’s office told the Guardian.

In response to Guardian queries about whether the Mayor’s Office had evidence that Italy had indeed submitted a bid, Project Manager Kyri McClellan of the OEWD forwarded a one-page resolution from the Italian prime minister assuring race organizers that there would be tax breaks, accelerated approvals, and other perks guaranteed if the Cup came to Italy. However, an Italian journalist who looked over the resolution told the Guardian that the document didn’t appear to be a formal bid, merely a response to a query from race organizers.

Daly has his doubts that either Valencia or the Italian port were ever seriously considered. “I think they were phantom bids,” he said, “created by either Larry Ellison or the Newsom administration … to place pressure on the Board of Supervisors.”

A representative from OEWD told the Guardian that officials have no reason to doubt that the European bids, and accompanying offers of money, were real. However, the city wasn’t privy to race organizer’s discussions about possible European venues. A final decision is expected before the end of the year.

Daly hasn’t held back in voicing opposition to the America’s Cup and blasted it at an Oct. 5 Board meeting. “This tacking around Sup. Daly will not get you in calmer waters,” Daly said. “I told myself I was not going to make a yachting reference. But I will bring a white squall onto this race and onto this Cup, and I will do everything in my power starting on Jan. 8 to make sure these boats never see that water.”

 

WIND IN WHOSE SAILS?

The America’s Cup would undoubtedly bring economic benefit to the area and create work at a time when jobs are scarce. Police officers would get overtime. Restaurant servers would be scrambling to keep up with demand. Construction workers seeking temporary employment would get gigs. Hotels would rake it in. Pier 39 would be booming. However, the Budget Analyst report cautioned: “It is unlikely that any labor benefits would remain in the years after the America’s Cup event is completed.”

Certain small businesses would catch a windfall. John Caine, owner the Hi Dive bar at Pier 28, didn’t hesitate when asked about his opinion on the city hosting the Cup. “Please come fix our piers. It’s a shout-out to Larry Ellison,” he said. Caine said he supports the America’s Cup bid 100 percent, and is excited about the boost it could give his business. The Hi Dive would not be required to relocate under the proposal, he added.

At the same time, other small business would be negatively affected, particularly those among the 87 Port tenants who would be forced to relocate to make way for the America’s Cup. The Budget Analyst’s report also notes that retail businesses in the area whose services had no appeal to race-goers might suffer from reduced access to their stores, since crowding and street closures would shut out their customers.

The sailing community has rallied in support of the Cup, and Newsom has received hundreds of e-mails from yachting enthusiasts from as far away as Hawaii and Florida promising to travel to San Francisco with all their sailing friends to watch the world-famous vessels compete.

Ariane Paul, commodore of a classic wooden boat club called the Master Mariners Benevolent Association, told the Guardian that she was excited about the opportunity for the America’s Cup to showcase sailing on the bay. “In the long term, it’s a win-win,” Paul said. “It would be great to have that boost.” As for the financial terms of the deal, she remained confident, saying, “I don’t think that the city is going to let Larry Ellison walk all over them.”

Sup. Ross Mirkarimi is often politically aligned with Daly, but not when it comes to the issue of the America’s Cup. As a kid growing up on the island of Jamestown, a tiny blue-collar community located off the coast of Rhode Island, Mirkarimi learned to sail and occasionally spent summers working as a deckhand. Every few years, the America’s Cup would come to nearby Newport, transforming the area into a bustling hub and bringing the locals into contact with famous sailors. It left an everlasting impression. When the BMW Oracle Racing Team secured the 33rd Cup off the coast of Valencia, Mirkarimi did a double-take when he saw a photograph of the winning team — his childhood friend from Rhode Island was on the crew.

Mirkarimi told the Guardian he supports bringing the Cup to San Francisco because of the economic boost the area will receive — if the Cup continues to return to San Francisco as it did for 53 years in Newport, he said, the city could look forward to a free gift in improved revenue associated with the event, and that could help quiet the tired annual debates over painful budget cuts.

At the same time, he acknowledged that the Budget Analyst report had prompted what he called healthy skepticism. “I think the onus is on the city and Cup organizers to make sure the benefits far, far outweigh the investment,” Mirkarimi said. “This effort is not just about making one of the wealthiest men in the United States that much more wealthy … That can’t be the case,” he said. “It has to be about what will the Cup do in order to be a win-win for the people of San Francisco.” Mirkarimi said he expected scrutiny of the details of the agreement at the Dec. 8 Budget and Finance Committee hearing: “Naturally, in this time of economic downturn … people want to know, what’s the outlay of cost, and what are we going to get in return?” 

Chronicle finally uses the P word: Progressive

The San Francisco Chronicle ran a good story yesterday on progressives hopes for appointing one of our own as the next mayor. But beyond being fair to progressives that are often demonized by a newspaper whose political sympathies lie with the downtown crowd, the article was notable for something else: it’s use of the word “progressive.”

For years, Chronicle editors have refused to use the word that is most commonly used to describe the people and ideology that controls a majority of the Board of Supervisors, opting instead to label progressives as “far-left” or “ultra-liberal,” while the economic conservatives in town get the reasonable-sounding label “moderate.”

Sources tell the Guardian that this bit of Orwellian wordsmithing started with former Editor Phil Bronstein and was fueled by Mayor Gavin Newsom complaining to Chronicle editors that calling his political enemies “progressives” made us sound too reasonable, rather than the wild-eyed radicals he considered us to be.

I and others have discussed this with Chronicle Metro Editor Audrey Cooper, and her bewildering argument is that progressive “is a politically loaded term that doesn’t mean much to our readers.” I’ve pointed out that the word is quite descriptive and has deep historical roots in California and its own caucus in Congress – and that labeling us “ultra-liberal” is far more loaded and pejorative – but to no avail.

I ran into the writer of yesterday’s story – Rachel Gordon, a solid reporter and former colleague from the City Desk NewsHour television program – at the Board of Supervisors meeting yesterday afternoon and she said that political reporters at the Chronicle have long been pushing to use “progressive” and the editors finally changed the policy.

I have a message in to Cooper and I’ll follow up in Comments if I learn anything more about how and why the decision was made. But it’s good to know the paper of record is now letting progressives be progressives. Maybe now we can get rid of the “moderate” label. How about SoLibEconoCons (socially liberal economic conservatives)? OK, maybe that still needs some work.

The mayoral selection last time

The last time the Board of Supervisors had to pick a mayor, things were very different. Former Sup. Dan White had just murdered Mayor George Moscone and Sup. Harvey Milk. The city was in shock. Board President Dianne Feinstein became acting mayor, and one week later, on Dec. 4, six of her colleagues — the narrowest possible margin — elected her to fill out Moscone’s term.

It’s worth looking back at what happened that week, not only because it’s a fascinating bit of political history, but because it gives some insights into how the current process should and shouldn’t go.
We’ve gone back and pulled not only the minutes of that meeting, but all of the relevant articles and editorials from the San Francisco Chronicle, the old San Francisco Examiner and the Bay Guardian, and while newspaper accounts are only the first, and often imperfect draft of history, the Chron had a good City Hall reporter, Jerry Burns, and you can get a lot from the day-by-day accounts.

For starters, everyone (even the Guardian) agreed that Feinstein did a good, almost uncanny job of keeping it together and managing the city in the week after the horrendous murders. But she was by no means the only, or consensus candidate for the job — Sup. Robert Gonzales announced his candidacy Dec. 1, and others were in the running until the end. The Guardian wrote at the time that Feinstein was fine as acting mayor – but shouldn’t be in office for the final 13 months of Moscone’s term.

Among the interesting elements of the drama:

— The process was riddled with Brown Act violations, and the selection of Feinstein was, in retrospect, almost certainly based on illegal meetings.  “Feinstein spent yesterday at her Pacific Heights home,where she talked with most of the supervisors,” a Dec. 4, 1978 Chronicle article by Burns noted. That would amount to an illegal meeting; under state law, then and now, meeting individually and serially in private with all or most of the members of a public board is a clear violation of the Brown Act.

At the time, however, nobody challenged Feinstein’s actions.

— Then, as now, there was a move to name a “caretaker” mayor who would fill out the remaining 13 months of Moscone’s term — and vow not to run again. But the conservative Examiner said that was a bad idea: In a Dec. 3 editorial, the paper, then owned by Hearst Corp., noted: “The City should not have to accept a “caretaker” mayor invested with only a thin veneer of authority.” The notion went nowhere.

— At least one name that was bandied around back then is in play again today: Then-Assembly Member Willie Brown.

— Feinstein got exactly six votes. Although in most casual historical accounts, she’s described as a clear, almost unanimous choice, that was far from true. In fact, Sup. Ron Gonzalez, who described himself as the board member most in synch with Moscone’s agenda, announced his candidacy Dec. 1, and as of Dec. 3, the day before the final vote, Russ Cone of the Examiner reported that “earnest and secretive negotiations among San Francisco’s nine supervisors to agree upon a mayor to replace the slain George Moscone today entered the final, feverish hours with no candidate ready to claim victory.”

At the Dec. 4th board meeting, Sup. Quentin Kopp moved to continue the decision for a week. Kopp – unlike most of his colleagues – had been avoiding the political furor in the days after the assassinations, saying it was unseemly to be making deals when city leaders ought to be in mourning. Feinstein and the six others who would ultimately elect her voted against the motion.

That would be a clear violation of law today; as a candidate, Feinstein would be unable to vote on anything that could promote her ascension to mayor. But no matter: The motion needed six votes, and only Kopp and Sup. Lee Dolson said Aye.

When the motion was made to name Feinstein as interim mayor, Kopp tried to ask her a few questions – particularly about her plans for various department heads. The city attorney quickly shut him down, saying Feinstein couldn’t legally answer or get involved in any debate.

Then six supervisors voted for Feinstein. Kopp and Dolson dissented. Feinstein by law had to abstain. And there were, of course, two empty seats; Dan White had just resigned and was in jail, and Harvey Milk was dead.

Why did Kopp vote no? There’s a back story, a key part of San Francisco political lore.

Feinstein had run for mayor twice before, in 1971 and 1975, both times finishing well out of the money. After her second defeat, she vowed she’d never do it again. In fact, the day before the assassinations, she had just returned from a trip to Nepal with her then-boyfriend (now husband) Richard Blum, and reporters asked her if she was going to run in 1979. “Not this time,” she said.

She and Kopp, longtime rivals, had cut a deal the year before. Feinstein wanted to be board president; Kopp wanted to be mayor. And Feinstein vowed that if Kopp would support her for board president, she’d stay out of the mayor’s race in 1979 and leave the field open for him.

And of course, immediately after the killings, she changed her mind. Kopp thought what was a bit slimly, and refused to vote for her for mayor. He challenged her in 1979, and narrowly lost, and her political career, so recently in the doldrums, was off and running again.

By the time a beaming Mayor Gavin Newsom took the stage at Tres Agaves, the chic SoMa restaurant, on election night, enough results were in to leave no doubt: the top two places on the California ballot would go to the Democrats. Jerry Brown would defeat Meg Whitman in the most expensive gubernatorial race in American history — and Newsom, who once challenged Brown in the primary and dismissed the office of lieutenant governor, would be Brown’s No. 2.

It might not be a powerful job, but Newsom wasn’t taking it lightly anymore. “We can’t afford to continue to play in the margins,” he proclaimed proudly, advancing a vague but ambitious agenda. “There is absolutely nothing wrong with California that can’t be fixed with what’s right with California.”

But around the city, as results trickled in for the local races, the talk wasn’t about Newsom’s role in the Brown administration, or the change the Democrats might bring to Sacramento. It was about the profound change that could take place in his hometown as he vacates the office of mayor a year early — and opens the door for the progressives who control the Board of Supervisors to appoint a chief executive who agrees with, and is willing to work with, the majority of the district-elected board.

At a time when the Republican takeover of Congress threatens to create gridlock in Washington, there’s a real chance that San Francisco’s government — often paralyzed by friction between Newsom and the board — could take on an entirely new direction. It’s possible that the progressives, long denied the top spot at City Hall, could put a mayor in office who shares their agenda.

This could be a turning point in San Francisco, a chance to put the interests of the neighborhoods, the working class, small businesses, the environmental movement, and economic justice ahead of the demands of downtown and the rich. All the pieces are in place — except one.

To make a progressive vision happen, the fractious (and in some cases, overly ambitious) elected leaders of the progressive movement will have to recognize, just for a little while, that it’s not about any individual. It’s not about David Chiu, or Ross Mirkarimi, or Chris Daly, or John Avalos, or Eric Mar, or David Campos, or Jane Kim, or Aaron Peskin. It’s not about any one person’s career or personal power.

It’s about a progressive movement and the issues and causes that movement represents. And if the folks with the egos and personal gripes and career designs can’t set them aside and do what’s best for the movement as a whole, then the opportunity of a generation will be wasted.

Folks: this is a hard thing for politicians to recognize. But right now it’s not about you. It’s about all of us.

It’s an odd time in San Francisco, fraught with political hazards. And it’s so confusing that no one — not the elected officials, not the pundits, not the lobbyists, not the insiders — has any clear idea who will occupy Room 200 in January.

Here’s the basic scenario, as described by past opinions of the city attorney’s office:

Under the state Constitution, Newsom will take office as lieutenant governor Jan. 3, 2011. The City Charter provides that a vacancy in the Mayor’s Office is filled by the president of the Board of Supervisors until the board can choose someone to fill the job until the end of the term — in this case, for 11 more months.

So if all goes according to the rules (and Newsom doesn’t try to play some legal game and delay his swearing-in), David Chiu will become acting mayor on Jan.3. He’ll also retain his job as board president.

On Jan. 4, the current members of the Board of Supervisors will hold a regularly scheduled Tuesday meeting — and the election of a new mayor will be on the agenda. If six of the current supervisors can agree on a name (and sitting supervisors can’t vote for themselves) then that person will immediately take office and finish Newsom’s term.

If nobody gets six votes — that is, if the board is gridlocked — Chiu remains in both offices until the next regular meeting of the board — a week later, when the newly elected supervisors are sworn in.

The new board will then elect a board president — who will also instantly become acting mayor — and then go about trying to find someone who can get six votes to take the top job. If that doesn’t work — that is, if the new board is also gridlocked — then the new board president remains acting mayor until January 2012.

There are at least three basic approaches being bandied about. Some people, including Newsom and some of the more conservative members of the board, want to see a “caretaker” mayor, someone with no personal ambition for the job, fill out Newsom’s term, allowing the voters to choose the next mayor in November, 2011. That has problems. As Campos told us, “The city has serious budget and policy issues and it’s unlikely a caretaker could handle them effectively.” In other words, a short-termer will have no real power and will just punt hard decisions for another year.

Then there’s the concept of putting in a sacrificial progressive — someone who will push through the tax increases and service cuts necessary to close a $400 million budget gap, approve a series of bills that stalled under Newsom, take the hits from the San Francisco Chronicle, and step out of the way to let someone else run in November.

The downside of that approach? It’s almost impossible for a true progressive to raise the money needed to beat a downtown candidate in a citywide mayor’s race. And it seems foolish to give up the opportunity to someone in the mayor’s office who can run for reelection as an incumbent.

Which is, of course, the third — and most intriguing — scenario.

The press, the pundits, and the mayor have for the past few months been pushing former Sup. Peskin as the foil, trying to spin the situation to suggest that the current chair of the local Democratic Party is angling for a job he wouldn’t win in a normal election. But right now, Peskin is no more a front-runner than anyone else. And although he’s made no secret in the past of wanting the job, he’s been talking of late more about the need for a progressive than about his own ambitions.

“If the board chose [state Assemblymember] Tom Ammiano, I would be thrilled to play a role, however small, in that administration,” Peskin told us.

In fact, Peskin said, the supervisors need to stop thinking about personalities and start looking at the larger picture. “If we as a movement can’t pull this off, then shame on us.”

Or as Sup. Campos put it: “We have to come together here and do what’s right for the progressive movement.”

Two years ago, the San Francisco left was — to the extent that it’s possible — a united electoral movement. In June, an undisputed left slate won a majority on the Democratic County Central Committee. In November 2008, Districts 1, 3, 5, and 11 saw consensus left candidates running against downtown-backed opponents — and won. In D9, three progressives ran a remarkably civil campaign with little or no intramural attacks.

The results were impressive. As labor activist Gabriel Haaland put it, “we ran the table.”

But that unity fell apart quickly, as a faction led by Daly sought to ensure that Sup. Ross Mirkarimi couldn’t get elected board president. Instead that job went to Chiu — the least experienced of the supervisors elected in that class, and a politician who is, by his own account, the most centrist member of the liberal majority.

This fall, the campaign to replace Daly in D6 turned nasty as both Debra Walker and Jane Kim openly attacked each other. Walker sent out anti-Kim mailers, and Kim’s supporters charged that Walker was part of a political machine — a damaging (if silly) allegation that created a completely unnecessary rift on the left.

And let’s face it: those fights were all about personality and ego, not issues or progressive strategy. Mirkarimi and Daly have never had any substantive policy disagreements, and neither did Walker and Kim.

In the wake of that, progressives need to come together if they want to take advantage of the opportunity to change the direction of the city. It’s not going to be easy.

“We’re good at losing,” Daly said. “I’m afraid we’re doing everything we can to blow it.”

The cold political calculus is that none of the current board members can count on six votes, and neither can Peskin or any of the other commonly mentioned candidates. The only person who would almost certainly get six votes today is Ammiano — and so far, he’s not interested.

“I know you never say never in politics, but I’m happy here in Sacramento. Eighty-six percent of the voters sent me back for another term, and I think that says something,” he told us.

It’s hardly surprising that someone like Ammiano, who has a secure job he likes and soaring approval ratings, would demur on taking on what by any account will be a short-term nightmare. The city is still effectively broke, and next year’s budget shortfall is projected at roughly $400 million. There’s no easy way to raise revenue, and after four years of brutal cuts, there’s not much left to pare. The next mayor will be delivering bad news to the voters, making unpleasant and unpopular decisions, infuriating powerful interest groups of one sort or another — and then, should he or she want the job any longer, asking for a vote of confidence in November.

Yet he power of incumbency in San Francisco is significant. The past two mayors, Newsom and Willie Brown, were reelected easily, despite some serious problems. And an incumbent has the ability to raise money that most progressives won’t have on their own.

Chiu thus far is being cautious. He told us his main concern right now is ensuring that the process for choosing the next mayor is open, honest, and legally sound. He won’t even say if he’s officially interested in the job (although board observers say he’s already making the rounds and counting potential votes).

And no matter what happens, he will be acting mayor for at least a day, which gives him an advantage over anyone else in the contest.

But some of the board progressives are unhappy about how Chiu negotiated the last two budget deals with Newsom and don’t see him as a strong leader on the left.

Ross Mirkarimi is the longest-serving progressive (other than Daly, who isn’t remotely a candidate), and he’s made no secret of his political ambitions. Then there’s Campos, an effective and even-tempered supervisor who has friendly relationships with the board’s left flank and with centrists like Bevan Dufty. But even if Dufty (who I suspect would love to be part of electing the first openly gay mayor of San Francisco) does support Campos, he’d still need every other progressive supervisor. Campos also would need Chiu’s vote to go over the top. Which means Chiu — who needs progressive support for whatever his political future holds — would have to set aside his own designs on the job to put a progressive in office.

In other words, some people who want to be mayor are going to have to give that up and support the strongest progressive. “If there’s someone other than me who can get six votes, then I’m going to support that person,” Campos noted.

Then there are the outsiders. City Attorney Dennis Herrera has already announced he plans to run in the fall. If the board’s looking for a respected candidate who can appeal to moderates as well as progressives, his name will come up. So will state Sen. Mark Leno, who has the political gravitas and experience and would be formidable in a re-election campaign in November. Leno doesn’t always side with the left on local races; he supported Supervisor-elect Scott Wiener, and losing D6 candidate Theresa Sparks. But he has always sought to remain on good terms with progressives.

All that assumes that the current board will make the choice — and even that is a matter of strategic and political dispute. If the lame duck supervisors choose a mayor — particularly a strong progressive — you can count on the San Francisco Chronicle, Newsom, and the downtown establishment to call it a “power grab” and cast doubt on the legitimacy of the winner.

“But choosing a mayor is the legal responsibility of this board and they ought to do their jobs,” Peskin said.

The exact makeup of the next board was still unclear at press time. Jane Kim is the likely winner in D6 and has always been a progressive on the School Board. She’s also close to Chiu, who strongly supported her. If Malia Cohen or Lynette Sweet wins D10, it’s unlikely either of them will vote for a progressive mayor.

Newsom also might try to screw things up with a last-minute power play. He could, for example, simply refuse to take the oath of office as lieutenant governor until after the new board is seated.

Chiu’s allies say it makes sense for the progressives to choose a mayor who’s not identified so closely with the left wing of the board, who can appeal to the more moderate voters. That’s a powerful argument, and Herrera and Leno can also make the case. The progressive agenda — and the city — would be far better off with a more moderate mayor who is willing to work with the board than it has been with the arrogant, recalcitrant, and distant Newsom. And if the progressives got 75 percent of what they wanted from the mayor (as opposed to about 10 percent under Newsom), that would be cause to celebrate.

But to accept that as a political approach requires a gigantic assumption. It requires San Franciscans to give up on the idea that this is still, at heart, a progressive city, that the majority of the people who live here still believe in economic and social justice. It means giving up the dream that San Francisco can be a very different place, a city that’s not afraid to defy national trends and conventional wisdom, a place where socioeconomic diversity is a primary goal and the residents are more important than the big companies that try to make money off them. It means accepting that even here, in San Francisco, politics have to be driven by an ever-more conservative “center.”

It may be that a progressive can’t line up six votes, that a more moderate candidate winds up in the Mayor’s Office. But a lot of us aren’t ready yet to give up hope.

With the general election just days away, campaign disclosure reports show that downtown interests are spending huge amounts of money to create a more conservative San Francisco Board of Supervisors and to pass Proposition B, Public Defender Jeff Adachi’s effort to make city workers pay more for their pensions and health insurance.

Much of the spending is coming from sources hostile to programs designed to protect tenants in the city, including rent control and limits on the conversion on rental housing units to condominiums. An ideological flip of the board, which currently has a progressive majority, could also have big implications on who becomes the next mayor if Gavin Newsom wins his race for lieutenant governor.

At press time, downtown groups were far outspending their progressive counterparts through a series of independent expenditure committees, most of which are controlled by notorious local campaign attorney Jim Sutton (see “The political puppeteer,” 2/4/04) in support of supervisorial candidates Mark Farrell in District 2, Theresa Sparks in District 6, Scott Wiener in District 8, and Steve Moss in District 10.

Prop. B has also been a big recipient of downtown’s cash, although labor groups have pushed back strongly with their own spending to try to kill the measure, which is their main target in this election.

But the biggest spender in this election appears to be Thomas J. Coates, 56, a major investor in apartments and mobile homes and a demonstrated enemy of rent control. He alarmed progressive groups by giving at least $250,000 to groups that support Farrell, Sparks, Wiener, Moss, and Prop. G, legislation that Sup. Sean Elsbernd placed on the ballot to cut transit operator wages and change Muni work rules.

Although Coates declines to identify with a political party on his voter registration, he donated $2,000 to President George W. Bush in 2004. More significantly, he was the biggest individual donor in California’s November 2008 election, when he contributed $1 million to Prop. 98, which sought to repeal rent control in California and limit the government’s right to acquire private property by eminent domain.

Coates, who is also a yachting enthusiast and sits on San Francisco’s America’s Cup Organizing Committee (ACOC), donated $100,000 on Oct. 20 for Farrell, $45,000 for Sparks, $45,000 for Moss, and $10,000 for Wiener through third-party independent expenditure committees such as the Alliance for Jobs and Sustainable Growth.

The group has already received thousands of dollars in soft money from the San Francisco Police Officer’s Association, the Building Operators and Managers Association, the Golden Gate Restaurant Association, and SEIU-United Healthcare Workers, which supports a high-end hospital and housing complex on Cathedral Hill.

Those downtown groups have spent close to $200,000 on English and Chinese language mailers and robo calls in support of Sparks, Wiener, and Moss in hopes of securing a right-wing shift on the board.

Progressive groups including California Nurses Association, the San Francisco Tenants Union, and the SF Labor Council have tried to fight back in the supervisorial races. While downtown groups spent more than $100,000 promoting Sparks in D6, labor and progressive groups spent $13,000 opposing Sparks and $72,000 supporting progressive D6 candidate Debra Walker.

In D8, progressive groups that include teachers, nurses, and transit riders have outspent the downtown crowd, plunking down $40,000 to oppose Wiener and $90,000 to support progressive candidate Rafael Mandelman. So far, downtown groups have spent about $100,000 to support Wiener.

But in D10, the district with the biggest concentration of low-income families and communities of color, downtown interests spent $52,000 supporting Moss and $5,000 on Lynette Sweet while the Tenants Union was only able to summon $4,000 against Moss. The SF Building and Construction Trades Council spent $4,000 on Malia Cohen.

But that’s small potatoes compared to what downtown’s heavy-hitters are spending. The so-called Coalition for Sensible Government, which got a $100,000 donation from the San Francisco Association of Realtors, has already collectively spent $96,000 in support of Sparks, Wiener, Moss, Sweet, Rebecca Prozan in D8, Prop. G and Prop. L (sit-lie) and to oppose Prop. M (the progressive plan for police foot patrols) and Prop. N (a transfer tax on properties worth more than $5 million).

The Coalition for Responsible Growth, founded by Anthony Guilfoyle, the father of Mayor Gavin Newsom’s ex-wife, Kimberly Guilfoyle (who now works as a Fox News personality), has received $85,000 from the Committee on Jobs, $60,000 from the Realtors, and $35,000 from SF Forward. It has focused on spending in support of Prop. G and producing a voter guide for Plan C, the conservative group that supports Sparks, Wiener, Sweet, and Moss

Coates’ donations raise questions about his preferred slate’s views on tenant and landlord rights. A principal in Jackson Square Properties, which specializes in apartments and mobile homes, Coates is the founding partner of Arroya & Coates, a commercial real estate firm whose clients include Walgreens, Circuit City, and J.P. Morgan Investment Management. In 2008, when he backed Prop. 98, Coates told the San Francisco Chronicle that rent control “doesn’t work.”

Ted Gullicksen, director of the SF Tenants Union (SFTU), which has collectively spent $30,000 opposing Sparks, Wiener, and Moss, is disturbed that Coates spent so much in support of this trio.

“Coates was the main funder of Prop. 98,” Gullicksen explained. “His property is in Southern California. He’s pumping a lot of money into supervisors. And he clearly has an agenda that we fear Moss, Sparks, and Wiener share — which is to make the existence of rent control an issue they will take up in the future if elected to the board.”

That threat got progressive and labor groups to organize an Oct. 26 protest outside Coates’ San Francisco law office, with invitations to the event warning, “Be there or be evicted!”

Sparks, Moss, and Wiener all claim to support rent control, despite their support by someone who seeks to abolish it. “I answered such on my questionnaire to the SFTU, which chose to ignore it,” Sparks told the Guardian via text message. “In addition, I’ve been put out of apartments twice in SF, once due to the Ellis Act. They ignore that fact as well.”

Records show that in May 2009, Moss — who bought a rent-controlled apartment building near Dolores Park in D8 for $1.6 million and he lived there from the end of 2007 to the 2010, when he decided to run for office in D10 — served a “notice to quit or cure” on a tenant who complained about the noise from Moss’ apartment. Ultimately, Moss settled without actually evicting his tenant.

“I read about Coats’ [sic] contribution in Bay Citizen,” Moss wrote in an e-mail to the Guardian. “This donation was made to an independent expenditure committee over which I have no control and almost no knowledge. I have stated throughout the campaign, and directly to the Tenants Union, that I believe current rent control policy should remain unmolested.”

But Moss is with downtown on other key issues. He supports Newsom’s sit-lie legislation and the rabidly anti-tenant Small Property Owners Association, whose endorsement he previously called a “mistake.”

Yet Moss, who sold a condo on Potrero Hill in 2007 for the same price he paid for the entire building in 2001, seems to voice more sympathy for property owners than renters, who make up about two-thirds of city residents. He told us, “Landlords feel that they are responsible for maintaining costly older buildings and that they are not provided with ways to upgrade their units in ways that share costs with tenants.”

Another realm where downtown seems to be trying to flip the Board of Supervisors on a significant agenda item is on health care, particularly the California Pacific Medical Center proposal to build a high-end hospital and housing project on Cathedral Hill in exchange for rebuilding St. Luke’s Hospital in the Mission.

The project has divided local labor unions. UHW supports the project and a slate of candidates that its parent union, Service Employees International Union, is opposing through SEIU Local 1021, which is supporting more progressive candidates. The California Nurses Association also opposes the project and candidates such as Wiener who back it.

“A recent mailer by CNA falsely says that CPMC is closing St. Luke’s and Davies,” CPMC CEO Warren Browner recently complained in a letter to the Board of Supervisors. “We are not. We are committed to building a state-of-the-art, high-quality replacement hospital at St. Luke’s and continuing to upgrade Davies.”

But the CPMC rebuild is contingent on the board approving the Cathedral Hill project. So the CNA mailer focused on what could happen if the city rejects the CPMC project: “We could lose two San Francisco hospitals if Scott Wiener is elected supervisor.”

SEIU-UHW’s alliance with downtown groups and its use of member dues to attack progressive candidates places it at odds with SEIU Local 1021 and the SF Labor Council, which has endorsed Janet Reilly in D2, Walker in D6, Mandelman in D8, and Cohen (first choice) and Chris Jackson (second choice) in D10.

“We’re really disappointed that there are labor organizations that feel they have to team up with Golden Gate Restaurant Association, which is against health care [it challenged the city’s Healthy San Francisco program all the way to the U.S. Supreme Court], and with CPMC, which is working to keep nurses from joining a union,” Labor Council Director Tim Paulson said. “This alliance does not reflect what the San Francisco labor movement is about.”

Paulson said that the Labor Council values “sharing the wealth … So we don’t want Measure B [Jeff Adachi’s pension reform] or K [Newsom’s hotel tax loophole closure, which has a poison pill that would kill Prop. J, the hotel tax increase pushed by labor] or L [Newsom’s sit-lie legislation],” Paulson said.

CPMC’s plan is headed to the board in the next couple months, although Sup. David Campos is proposing that the city create a health services master plan that would determine what city residents actually need. Hospital projects would then be considered based on that health needs assessment, rather than making it simply a land use decision as it is now.

Moss told the Guardian that UHW endorsed him because of his positions on politicians and unions. “I agreed that politicians should get not involved in union politics,” Moss said. “The United Healthcare Workers seem to be a worthy group,” he added. “All they said was that they wanted to make sure that they had access.”

But CNA member Eileen Prendiville, who has been a registered nurse for 33 years, says she was horrified to see UHW members recently oppose Campos’ healthcare legislation. “I was shocked that they were siding with management,” she said.

Prendiville believes UHW is obliged to support CPMC’s Cathedral Hill plan, which is why it is meddling in local politics. In his letter to the board, Browner noted that his company and its parent company, Sutter Health, can’t legally do so directly. “The fact is that CPMC and Sutter Health are 501(c)(3) not-for-profit, nonpartisan organizations, and we neither endorse nor contribute to candidates,” Browner wrote.

“When UHW settled its contract with its members [as part of its fight with the rival National Union of Healthcare Workers], they had to publicly lobby for Cathedral Hill,” Prendiville claimed.

SEIU 1021 member Ed Kinchley, who works in the emergency room at SF General Hospital, is also furious that UHW is pouring money into downtown’s candidates and measures. “UHW isn’t participating in the Labor Council, it’s doing its own thing,” he said.

Kinchley said UHW, which is currently in trusteeship after a power struggle with its former elected leaders, is being controlled by SEIU’s national leaders, not its local membership, which explains why it’s aligned with downtown groups that have long been the enemy of labor.

“Sutter wants a monopoly on private healthcare and people like Rafael Mandelman and Debra Walker have been strong supporters of public healthcare,” Kinchley said. “I want someone who can straight-up say, here’s what’s important for families in San Francisco, especially something as important as healthcare. PG&E fast and loose on repairs, tight-lipped on info

It was clear at several times during the Oct. 19 Senate committee hearing that Pacific Gas & Electric Co. had done a poor job of communicating with those affected by the pipeline explosion that brought catastrophe to San Bruno, a practice that is in keeping with its longstanding pattern of secrecy.

Kathy DeRenzi, a survivor who testified at the hearing, noted that she had written several letters to PG&E since the event, addressed to Vice President of Gas Operations Kirk Johnson. “I haven’t heard back from anyone,” she said. DeRenzi also noted that she has been in close contact with many affected residents since the blaze, and very few had received notification that the hearing would be held. “There would’ve been a lot more people here” had they known, she said.

San Bruno Mayor Jim Ruane also complained of the utility’s lack of communication. In the weeks following the blaze, he said, the company started a repurchasing program for residents whose homes had been damaged — but never mentioned it to city officials. “The city was never informed,” Ruane said. “It’s kind of a mixed message when we find out from the media about this program.”

Weeks earlier, the company continued to hide crucial information about its top 100 priority repairs until intense public pressure forced it to release the list. A recent article in the San Francisco Chronicle noted that two key PG&E employees who were on duty the night of the explosion declined to be interviewed by federal investigators about the pressure spike in the gas pipeline, saying they were “too traumatized” to talk.

PG&E also ignores the inquiries of certain media outlets. When a Guardian reporter attempted to approach Johnson to ask a question, media relations representative Joe Molica stood in the way and insisted that Johnson didn’t have time to talk. Asked for contact information so that an interview could be set up later, Molica appeared to search for a business card but came up empty-handed.

He then refused outright to provide his phone number or e-mail address. Asked why a media relations representative could not share his e-mail address with a reporter, Molica scoffed. “Because it will end up on some blog,” he snapped.

I’ve been hanging out with the Haight Street kids. Over the course of a week or so, I smoked weed, drank malt liquor, witnessed nasty run-ins with police officers — all events that anyone who has walked down the sidewalks of that legendary street would expect. But I also met people who’d give away their last dollar to a friend, people who know a thing or two about community, and people who don’t see sidewalks only as thoroughfares to commerce.

Ironically, though the homeless kids on Haight are the explicit inspiration for Proposition L, the sit-lie measure on the Nov. 2 ballot, their voices have been significantly absent from the vitriolic debate on its merits and faults. Ironic because of all people, it’s these young men and women — and the citizens of San Francisco who interact humanely with them — who could teach us the most about what public space in San Francisco could be.

I didn’t just stand with a notebook, fire questions, and walk away. I took a seat and spent time with the kids, to see for myself whether its true that they’re harassing people, letting their dogs run amok, and generally ruining everyone’s lives as much as sit-lie supporters say they are. That it turned out to be uplifting was an added bonus. I got to see what many don’t on their way to shop for souvenir bongs, retro dresses, and designer skateboards — the reason young people from around the country come to the neighborhood.

It doesn’t have anything to do with fancy Victorians and boutiques, which may explain the disconnect between the street kids and their detractors. They come for the legacy of individuals brave enough to slough off social mores that Haight-Ashbury residents are so ostensibly proud of — not to mention the companionship of others who are comfortable with their rejection of and by society. They come to share stories and pipes and encouragement, and it was cool to watch a streetscape in San Francisco that wasn’t geared solely to commerce.

And while the young people I talked to told me how much they liked to travel, to live free of convention and without ties to the workday world, after a while most acknowledged that they had left behind families who couldn’t or didn’t care for them, home situations that were uncomfortable enough to make life on the streets seem like a better alternative.

Although violent incidents, uncivil behavior, and threatening dogs are well-documented by other news sources, I didn’t see any of that when I was hanging out on Haight. That doesn’t mean that these things don’t exist — but it might suggest that some of the strident supporters of Prop. L are seeing what they want to see.

SPANGING

Steven, who asked us not to use his full name, is 20 and homeless. He grew up in Stockton, became a welder after high school, then decided he “didn’t want the hassle” of staying put for a wage job. His fingernails play host to an ungodly amount of dirt, but his tight blonde curls, pretty golden eyes (“they look like a lion’s!” says one friend in amazement) and mellow, generous demeanor make him a popular hub among his homeless peers.

It doesn’t hurt that he sells weed, small amounts at a time to passing tourists and acquaintances. He silently passes a pipe around to his companions with the slightest provocation. Steven approached me on the street before he knew I was a journalist, a fact that seemed to make little difference to him.

He says he came to the Haight “for the people,” for the area’s reputation of open souls and unconventional artists that originated in the glory days of Janis Joplin and the Grateful Dead. Like most of the kids I talked to, he eschewed the often dangerous shelter scene to sleep in Golden Gate Park or nearby Buena Vista Park despite the police surveillance that could result in spendy fines for park camping.

Although Steven’s worldly possessions fit into the large camping backpack he carries with him 24 hours a day, and even though he’s been living on Haight less than nine months — broken by a jaunt to Eugene, Ore., where he found it “too rainy” to join the town’s expansive street kid community — he doesn’t plan on being homeless forever. It’s just that nothing about this economic climate inspires him to sell his freedom for a paycheck. He plans to go to a four-year college eventually. He sees an education as the only way to get a “real” job. “But until then, why not do this?” he asks. I’m not sure if he’s waiting for my answer.

“This” is sit on Haight Street and “spange,” the term used for “flying a sign” and asking shoppers and neighbors walking by for money, often in a creative way. Of the many crimes street kids are guilty of in the eyes of supporters, spanging is the only one Prop. L would effect.

If Francisco voters approve it, anyone who sits or reclines on the sidewalk (with exceptions for the handicapped and those with permits — but not for the tired, workers on breaks, or people waiting for buses) will be subject to a fine of $50 to $100 for the first offense and $300 to $500, or a maximum of 10 days in jail, for someone found guilty twice within 24 hours of unduly supporting his or her body on the sidewalk between 7 a.m. and 11 p.m. Similar laws can be found up and down the West Coast — although Portland’s was pulled from the books last year after being found unconstitutional because it targeted the homeless.

I ask street kid after street kid why they’ve chosen this lifestyle. Many wouldn’t have it any other way. “Why do people want us off the street?” says Oz, a 21 year old from upstate New York who deals alongside Steven. “Probably because they can’t do this themselves.”

Though I’m skeptical at first, after a while I see why the unconventional group of “travelers” on Haight choose to spend their time spanging. Conversations get struck up with the most unusual people — the old hippie who bought a new Mad Hatter cap for the weekend, the suburban woman who might or might not like to buy some weed (she can’t decide). When a few businesses ask us to move so they can sweep the sidewalk or clear a doorway, the street kids I’m watching relocate with little protest. Many who walk past Steven seemed to find humor in his sign, which that day reads “Are you one paycheck away from having this be your job too?” He says he likes to switch his message daily. “Keep it fresh.”

By hanging out with the spangers, I get to see a Haight Street with human interaction at its core. People walk by, often dropping off surprisingly generous gifts: a ex-Grateful Dead roadie with a massive beard who lives in Fairfax and stopped by the neighborhood for a quick lunch with his daughter parks in front of Steven’s group and approaches them. “You kids hungry? You look like you could use a pizza.”

He emerges a half-hour later with a large cheese pie and drives away after chatting for a few minutes about the old days, to the glee of the group (many of the street kids are Dead Heads). The kids eat their fill, then start handing out the remaining pizza to people walking by, a comic role reversal. “I like to support the community — they get back all the money they get sucked out of them,” Steven tells me.

“NARCOTIC FUELED, ANTISOCIAL THUGS”

The campaign to put a sit-lie ordinance into effect in San Francisco kicked into gear with a Saturday morning stroll. As San Francisco Chronicle columnist C.W. Nevius — who regularly publicizes complaints against the Haight street kid culture — reported Feb. 27, Mayor Gavin Newsom recently relocated to the neighborhood and saw evidence of drug use on the main stretch of Haight where he was walking with his infant daughter. “As God as my witness, there’s a guy on the sidewalk smoking crack,” Newsom reportedly said.

The mayor threw his support behind a sentiment already being voiced by the Haight Ashbury Improvement Association, a resident-merchant alliance in the area. HAIA sees the street kids as disruptive outsiders. “These are not the flower children of the 1960s. It’s narcotic fueled, antisocial thugs who act like a quasi-gang,” Ted Loewenberg, president of the association, was quoted as saying in Business Week.

Adds the Prop L website: ” … the Haight-Ashbury district — once synonymous with peace and love — this corridor is now a hot spot for street bullies, pit bulls, and drug abuse.” It’s a deft cultural lobotomy that dissociates drugs from the Summer of Love, and a devious one that implies that street kids weren’t major players in that social revolution.

As for the bullies, I didn’t see any violence from the street kids in the days and nights I spent out on Haight Street.

I couldn’t get cops to talk to me about it, either. There were two police officers on foot traversing Haight’s main strip and I introduced myself when they stood chatting with a coffee shop owner in the afternoon sunshine and asked them about the sort of neighborhood complaints they regularly received about the street kids.

“No comment,” Cop No. 1 told me. Okay, Cop No. 2, your thoughts? “I don’t speak English.”

To my requests that they share their view of crime on Haight, I could get one response: “It’s complicated.” Later, when I returned to write down their badge numbers, they were standing silently, staring at a lone young man sitting against a wall next to his skateboard. The kid was looking at the ground. Eventually they handcuffed him and put him in a police car while he pleaded meekly about it “only being a little bit of weed — and I was only skateboarding on the sidewalk.”

The most aggression I witnessed from any party took place while I was tapping my feet to a group of traveling bluegrass musicians performing around 10 p.m. on a Thursday. Their cover of Del Shannon’s “Runaway” had inspired an older homeless man to strike up a curiously graceful stomp dance on the sidewalk. He was so drunk and fully immersed in the music that the bottle of Jim Beam in his flailing hand didn’t even register when the police officer approached him and asked, “What do you think you’re doing?”

The musicians began to pack up. “I could have told you this would happen 20 minutes ago,” one tells me, nodding toward the old man. “Don’t say a word or I’ll fucking take you in,” said the cop, who poured out the half-full bottle and wrote a ticket for the older man, who had made a few feeble protests that ended abruptly with the cop’s obscenity.

The officer said he’d received a complaint about the music, a line I heard from each cop I came into contact with on Haight — including one officer who cautioned a family with a toddler to pack up the bracelets they were selling to pay the towing charges on their van. “People don’t like to see people with kids out here, you better move it along,” the cop said.

“I’ve seen aggression because people start shit,” Steven tells me when I ask him about his experience with street violence. A man has just walked by chanting “dirty, dirty” in Steven’s and his friends’ faces. “They don’t like to see people sit on the ground.”

“There are people who come down here just to make themselves look better,” chimes in Oz. “Like ‘ha ha ha, I have air conditioning.’ All kinds of people start shit”

I asked if they knew they were the focus of a massive political debate in San Francisco. “No, what debate?” asked Steven.

“You mean sit-lie?” Oz asks. “It probably has to do with tourism. I don’t see why else they would do that.”

Even the most well-known recent case of Haight Street violence — which was reported June 11 by New York Times reporter Scott James as having “inspired a grass roots movement” that propelled Prop. L, seems to be a question of mutual aggression on the two sides of the street kids issue.

The story goes that a man named Thomas was hosing down the sidewalk in front of his house — a practice that is growing more common in the Haight to make property inhospitable to the homeless. He found himself “surrounded and engaged in a heated confrontation,” as James reports. Thomas reportedly shouted “Do you want a piece of me?” and a scuffle erupted between him and Chad Potter, a 26-year old homeless man, culminating with Potter being arrested and set free the next day. Thomas says Potter and friends continued to harass him after the incident.

James Orr, 24, is busking with his flute when I meet him sitting by a store that sells flowing hippie skirts and bumper stickers that command future tailgaters to “Coexist.” He’s looking to trade his wind instrument for a banjo, which he plays in addition to guitar. A rolling stone, Orr is in town for the Hardly Strictly Bluegrass festival that weekend — he travels the country going to festivals, and even scored a job recently at upstate New York’s Mountain Jam for the event’s blog site, taking photos with a borrowed camera of performances by (ex-member of The Band) Levon Helm and Michael Franti.

Orr’s quite erudite and eager to “say something articulate” about the situation of the street kids and travelers on Haight. He tells me that yeah, he’s seen aggression go down here on occasion. But he resents those situations leading to laws against sitting on the street.

“It’s another example of the few that do mess up casting a bad light on everyone else. Most of us just want to make some money, put a smile on someone’s face.” As a busker, he finds it baffling that people who are against the presence of the homeless would want him to stop plying his trade by making sitting illegal. “You should point out also that it’s how we make money!” he exclaims.

THE PIT BULLS

Snarling ruffians on frayed rope leashes stalking the city streets! As evidenced by the Civil Sidewalks campaign, dogs — specifically pit bulls — are another source of controversy on the pavement. Last December, SFist identified a C.W. Nevius tirade against the breed as example of its ongoing feature “Pit Bull Hate Watch.” The paper has pointed out that the demonized dogs can make great members of society and are often the subject of a media smear campaign.

But for many homeless youth, their dogs aren’t the means of imposing chaos on the gentry. They keep them for the same reasons we do: friendship, protection, love — and during the days I spent on Haight, it was a pleasure to pat the doggies while interviewing their owners. Most were as gentle and laid back as the kids they sprawled next to, a reasonably expected result from the 24 hours a day of socialization with humans that the homeless lifestyle affords.

Smiley is an inveterate street kid unlikely to go indoors anytime soon. “I don’t know how to do anything else,” she tells me. Now in her early 20s with a shock of magenta, purple, and dirty blonde hair and fanciful purple ear plugs that pierce her lobes before spiraling nearly to her shoulders, she’s been traveling since she was 12 — “a Bohemian by blood,” as she puts it. Not only did her parents move their household regularly throughout her childhood, but their heritage is Romani, from the traveling tribes of Eastern Europe.

For Smiley, travel outside the bounds of business trips and weekend vacations is her life’s norm, and Haight Street’s legacy resounds in her nomadic soul. “Most of the people that travelers idolize were here,” she tells me.

Smiley has a year-old behemoth black mutt with droopy eyes. He obliges her as she leans into him holding her spanging sign, which tells the world the pup needs Benadryl for an upcoming van ride to Southern California. “He’s carsick,” she tells me sheepishly. She admits that the dog can limit her mobility on public transportation, but his benefits outweigh his cost. He keeps her warm at night — and, more important for a young woman who is often on her own, he protects her. For a moment breaking out of tough girl mode, she tell me, “oh yeah, I don’t have to worry about anything when he’s around.”

We talk about the perceived threat of dogs on Haight Street. “They want us to leash them, which I guess I understand — but look at that!” A well-dressed woman in her 40s has her Chihuahua off its leash and it has run into the busy street, with her in hot pursuit. “That dog’s out of control,” Smiley smiles.

PISS

Sitting against a mural on a wall where Haight meets Clayton, I watch Piss, an outgoing, gangly guy in his early 20s with a curly blonde mohawk in a growing-out stage. I ask him where he got his unusual moniker. “I like to get drunk and piss on things,” he says.

Well. Originally from Billings, Mont., Piss has been traveling since his mid-teens. “Let’s just say me and my family don’t get along,” he tells me.

His answers to my questions about why he’s on the streets follow a path I see with many of the younger homeless youth: they insist that the lure of the open road was too hard to ignore, but eventually reveal that their parents kicked them out or were unable to care for them at a young age. Many, like Juju, another small-time weed dealer I met, bounced from family member to family member until frictions with them and their significant others left no recourse but the street.

Piss says he’s been to every state in the country, plus Canada and Mexico. With so many years on the road, he is, as they say, letting his freak flag fly. Piss has a blue, vaguely tribal tattoo that curls around his right eye. He’s wearing white tube socks on the dirty pavement. At first glance, he could be crazy — and maybe he is. Whatever his motivation for travel, it’s not to blend in with the locals.

Piss is also actively spanging passersby in a manner that oscillates between off-putting and charming. “You got some money for some crack and ice cream?” he inquires of a passing trio of young women. They shake their head, but before they’re gone completely he continues “I’m just kidding! I don’t like ice cream! Hey miss, you have a nice ass … day!”

Over the course of the hour that I watch him a stand up routine emerges. Beneath the grime, he’s a charismatic kid with an enviable sense of comedic timing.

As he ranges up and down a 20-foot stretch of sidewalk, belly laughs are elicited from a few targets, dollars surfacing here and there. One man carrying an accordion and wearing an expensive-looking pair of leather Chaco sandals donates a handful of strawberries to Piss and to those of us acting as his entourage.

But Piss’ play is a little rough — like a big puppy — and he’s alienating the people who don’t crack up over crack. A couple of people walk away quickly from his petitions shaking their heads over one of the zingers, their suspicions confirmed about those rowdy Haight Street kids.

He’s not doing anything more than what young travelers do all over the world. Thousands of families bid see you later to young adults en route to Prague, Peru, and Perth each year, where they lug their dirty backpacks through the world’s most wondrous towns.

Of course, these kids aren’t sleeping in the public parks of Cuzco — but in countries with plenty of cheap travelers’ hostels, you don’t have to. And though international flights cost more than the van rides and freight train hops that brought in most of the Haight Street kids, backpackers abroad do the same things: take fewer showers and flaunt social norms — not because they want to cause a problem for the natives of the lands they pass through, but because they are young, and discovering themselves for the first time, and can’t see much past that. Piss isn’t being violent, but he has lost the language to deal with “normies” and he’s seen as unpredictable to the not-traveling, not-disenfranchised around him. Which to those who see public space as a place that should be predictable, mean he’s a threat.

The clash between the settled and transient in the Haight is not new. Indeed, it’s what made the neighborhood famous. As far back as the mid-1960s, officials have been simultaneously fighting and publicizing the Haight’s worldwide reputation as a traveler’s meeting place, a place with a culture of loosened societal moorings and enlightenment through free love, drugs, and art.

Businesses claim that the omnipresent homeless drive away paying customers from Haight Street. It a curious claim in an area where the vagrant hippie culture made the place the tourist attraction it is today, and one that is belied by the entry of Whole Foods, which plans to open a branch this year at a lot at Haight and Stanyan vacant since 2006. When contrasted with the Tenderloin — another neighborhood with a visible street community — and its chronic problems attracting a grocery store, the Haight street kids’ effect on local commerce doesn’t seem to be all that grave.

They certainly aren’t making the place any less desirable of a neighborhood to live in for the wealthy. Real estate website Trulia.com puts the median listing price for homes in the Haight-Ashbury neighborhood at $962,264.

The Haight Street kids I spoke could all too easily see what sit-lie would mean for San Francisco. When you control public space, you control who is in public space — and they have no illusions about whether or not they’re included in the perfect world of those who push the measure. If it’s enacted, the subculture that made Haight famous — part of which still survives today in a different form — would be gone, leaving it sterile and safe for the head shops and clothing boutiques, an even less authentic version of the ’60s love fest their patrons come to the street for. One wonders if a scrubbed-clean Haight is even what the residents and business owners who have thrown their lot behind sit-lie truly want, or if they’ve been duped into sit-lie’s efficacy by the same forces that on a national level have convinced us that curtailing civil liberties will lead to freedom for the real Americans. It comes down to this: What do we want Haight Street to be? Do we want to capitalize and benefit from the accepting, messy, wildly creative legacy the 20th century endowed our streets, or do we want a clean, friendly, outdoor mall? The powers of homogenization and gentrification can demonize the little heathens on Haight Street all they want, but they’ve miscalculated if they think that they don’t belong in San Francisco — after all, Haight created them, not the other way around.

Incumbent Carole Ward Allen has been a disappointment, part of the moribund BART establishment that wastes money on pointless extensions, ignores urban cores, and can’t control its own police force. Robert Raburn, a bicycle activist with a PhD in transportation and urban geography, would be a great replacement. If he’s elected, and Bert Hill wins in San Francisco, BART will have two more progressive transit activists to join Tom Radulovich. Vote for Raburn.

We’re not thrilled with her more recent positions years (against raising condo conversion fees and for new high-rises downtown), but she has no strong credible opponents. Green Party Jasper Kingeter has never run for elective office before and needs more seasoning.

JESSE ARREGUIN

Arreguin and Kriss Worthington hold down the progressive wing on the City Council. He’s pushed the Berkeley police to stop impounding the cars of undocumented immigrants and is a foe of the development-at-all costs mentality of the mayor.

DISTRICT 7

KRISS WORTHINGTON

It’s disappointing that Mayor Tom Bates and his allies are trying to get rid of Worthington, who by our estimation is the best, hardest-working, and most progressive member of the City Council. He’s been willing to stand up to the mayor when he’s wrong — and has managed to force developers to build more affordable housing. He’s against the mayor’s downtown plan, but sees a way forward to a compromise that includes all the positive elements without big high-rises. Vote for Worthington.

DISTRICT 8

STEWART JONES

Gordon Wozniak, the incumbent, is the most conservative member of the City Council and has been a bad vote on almost everything. He’s going to be tough to beat in this district, but we’re giving the nod to Jones, a teacher, Green Party member, and neighborhood activist. He lacks experience, but almost anyone would be better than Wozniak.

The danger in this race is Don Perata, the former state Senate president, longtime power broker, and friend of developers who has, at the very least, a checkered ethical record that led at one point to a five-year federal corruption investigation (the investigation ended with no charges filed). Perata wants to use the mayor’s office to continue his role as a regional kingpin, and he has the support of Pacific Gas and Electric Co. and the big developers. No thanks.

Two strong progressive challengers are taking him on. Our first choice is Rebecca Kaplan, an at-large City Council member who is full of great, innovative ideas for Oakland. She wants to enforce an Oakland-first hiring law, work on transit-oriented development, and encourage small businesses that can attract some of the $2 billion a year Oakland loses in retail sales from local residents who shop out of town.

Kaplan told us she thinks that if Proposition 19 passes and local government has the right to regulate legal marijuana, Oakland is perfectly situated to take advantage of the new law. By combining pot sales and possibly on-site consumption with new restaurants, bike lanes, and street-level amenities, the city could revitalize neighborhoods and bring in significant new tax revenue.

She’s a big bicycle advocate, would consider a progressive city income tax, and is a strong supporter of public power. She also has a practical sense of how to solve problems.

Jean Quan has been active in Oakland politics for decades. She served 12 years on the school board, eight on the City Council, and has the experience, skills, and vision to run the city. She’s also almost tied in the polls with Perata, despite being outspent dramatically (and being the subject of some nasty, inaccurate Perata hit pieces). She told us she wants to be a cheerleader for the public schools, to work with local businesses, expand the high school internship program, and add city wrap-around services to public schools. She’s had a long, impressive record on environmental issues (she worked with San Francisco on a plastic bag ban and wrote Oakland’s Styrofoam ban). She recognizes that much of the city’s budget problem comes from the police department and police pensions. But she’s a little less aggressive than Kaplan about raising new revenue, and while she fully supports Prop. 19 and the Oakland plan for allowing commercial marijuana operations, she is, in her own words, “relatively conservative” on how far Oakland should go to allow sales and use in the city.

Kaplan’s got more of the cutting-edge progressive vision. Quan’s got more experience and a longer track record. They’re the two choices to beat Perata and save Oakland’s future, and we’re happy that ranked-choice voting allows us to endorse them both.

JENNIFER PAE

Patricia Kernighan is among the most conservative votes on the council. She’s also representing a wealthy, conservative hills district and will be hard to beat. We’re endorsing Jennifer Pae, community outreach director for the East Bay Voter Education Consortium. She has the backing of progressives like Supervisor Keith Carson and Berkeley City Council Member Kriss Worthington (as well as the Alameda County Green Party). She’s a long shot, but better than the incumbent.

The front-runners in this race are probably Libby Schaaf, a former aide to Ignacio de la Fuente; Melanie Shelby, a small business owner; and Daniel Swafford, a business consultant. Schaaf is too close to her old boss. We liked Shelby, but she’s awfully vague on solutions to Oakland’s problems — and she voted for Prop. 8. She now says her position on same-sex marriage is “evolving,” and she supports equal rights for all couples. But that’s an awfully big issue to have taken an awfully wrong stand on just two years ago.

This leaves Swafford, a neighborhood activist who grew up in Oakland and was City Council Member Jean Quan’s appointee to the Neighborhood Crime Prevention Council and is a strong advocate of community policing. He gets the nod.

DISTRICT 6

JOSE DORADO

Conventional wisdom says Desley Brooks is almost certain to get reelected to this seat. Her only competition comes from Nancy Sidebotham, whose platform is all cops all the time, and Jose Dorado, a bookkeeper with little political experience. Brooks is a fierce advocate for her district and has been tough on banks and good on pushing local hiring, but has too many ethical problems to merit our endorsement. She has never denied that she kept her boyfriend’s daughter on as a $5,000-a-month aide while the young woman was a full-time student at Syracuse University in New York. When San Francisco Chronicle columnist Chip Johnson challenged some of her ethical lapses, she sued him for libel (the case was dismissed).

Dorado is a neighborhood activist who is running a grassroots campaign and, while he needs more experience, he’s raising good issues (like public financing of elections). And unlike Sidebotham, he’s supporting the revenue measures on the ballot.

 

East Bay Ballot Measures

BERKELEY MEASURE H

SCHOOL FACILITIES TAX

YES

The East Bay cities have done a much better job than San Francisco at using parcel taxes — a poor substitute for property taxes but still a relatively progressive form of revenue — to support schools and other public services. Measure H would continue an existing tax on residential and commercial buildings — 6.3 cents per square foot on residences and 9.4 cents on businesses — to pay for maintenance on public school buildings. Vote yes.

 

BERKELEY MEASURE I

SCHOOL BONDS

YES

Measure I is a $210 million bond act to expand and upgrade the public schools. Vote yes.

 

BERKELEY MEASURE T

CANNABIS PERMITS

YES

Measure T is on the ballot as part of Berkeley’s effort to implement Prop. 19, the statewide pot-legalization measure. Berkeley and Oakland are both ahead of San Francisco in planning for legal marijuana. Prop. T would allow six medical cannabis clinics with cultivation permits, but restrict future industrial pot uses to industrial districts. Vote yes.

 

OAKLAND MEASURE L

SCHOOL TAX

YES

Another parcel tax for schools, this one $195 a year for 10 years, essentially to offset state cuts. There’s an exemption for low-income taxpayers. Vote yes.

 

OAKLAND MEASURE V

CANNABIS TAXES

YES

If Oakland goes ahead with its plans to allow large-scale cultivation and passes this tax hike on pot sales (to $50 per $1,000 of gross revenue for medical pot and $100 per $1,000 for recreational pot) the city could take in as much as $30 million a year — almost enough to offset the budget deficit. Vote yes.

 

OAKLAND MEASURE W

PHONE LINE TAX

YES

Another creative — if imperfect — way to raise some revenue, Measure W puts a modest $1.99 a month tax on phone lines to raise money for the general fund. Vote yes.

 

OAKLAND MEASURE X

POLICE PARCEL TAX

NO

We typically support any reasonable tax on property to pay for public services, but we can’t back this one. Measure X would impose a fairly high ($360 a year) parcel tax on single-family homes — entirely to pay for cops. The police union has been intractable, refusing to give back any of its generous pension benefits to help solve the budget deficit. We can’t see raising taxes for that department alone when so much of Oakland is hurting for money.

 

OAKLAND MEASURE BB

POLICE FUNDING

YES

Measure BB would allow Oakland to continue collecting violence-prevention money under a previous ballot measure even if the police department falls below a mandated staffing level. It would give the City Council more flexibility in addressing public safety. Vote yes.

A trio of great Hispanic leaders

It’s Hispanic Heritage Month, an excellent time to remember three of the most important Hispanic labor leaders in U.S. history. All three were engaged in the much needed and very tough job of organizing and improving the generally poor conditions of the nation’s largely Latino farm labor force.

Cesar Chavez, of course, is one of the farm worker leaders we should particularly honor. Another is Dolores Huerta, who joined Chavez in founding the United Farm Workers union – and who, in fact, is still organizing and otherwise helping Latino workers, particularly women.

The third leader who’s especially deserving of honor is the lesser known but no less important t pioneer farm labor organizer, Ernesto Galarza. Despite his important work, Galarza has been largely forgotten – though certainly not by me.  He’s been dead now for a quarter-century, but I recall him well from my days as a reporter covering farm labor:

His shining, black hair and fierce, penetrating gaze. His angry, intense words and slashing speeches against those who resisted demands for reform. His scholarly writing and novels and poetry – and his teaching.

Galarza was one of the loudest and most unusual of the voices that have been raised for the farm worker. He had a Ph. D., wrote a half-dozen books and numerous pamphlets and articles , and taught at all levels, from elementary school to university.

Yet Galarza was also an active union organizer – a key leader in laying the groundwork for the farm labor movement led by Cesar Chavez.

Galarza came to California’s fields in 1948, as an officer of the American Federation of Labor’s now long gone National Farm Labor Union. He had grown up in California, and had worked on farms as a teenager.

But Galarza had left that behind to head off to college on a scholarship and, eventually, to Columbia University for a doctorate in Latin American affairs.

After that, Galarza worked for the Pan American Union in Washington – until, characteristically, he became enraged over what he felt was the organization’s overlooking the exploitation of Latin American workers by US business interests. He resigned to take the job with the National Farm Labor Union.

Galarza led several strikes, but he was completely thwarted by the federal Bracero program that allowed growers to import penniless, undemanding Mexican workers to replace US workers who dared to strike or otherwise seek better treatment. So Galarza shifted his efforts into trying to abolish the Bracero program.

For more than a dozen years he fought a frustrating and often lonely battle. He spoke out endlessly before legislative committees and elsewhere, He issued hundreds of reports documenting the abuses of U.S. and Mexican workers under the Bracero program,. But the program remained untouched, and by 1960, Galarza’s union was gone. Near exhaustion, he turned mainly to writing and teaching.

But finally, in 1964, the public pressure that Galarza had a key role in generating led Congress to kill the Bracero program. It’s no coincidence that year, 1964, was the same year in which Cesar Chavez began his organizing drive. For Galarza was correct: The existence of the Bracero program had made farm labor organizing impossible.

By the time of Galarza’s death at 78 in 1984, the Chavez-led United Farm Workers had become an effective, nationally supported union.

The farm labor system still relies heavily on desperately poor immigrant workers, But thanks to the farm workers union that Ernesto Galarza helped bring about, many workers have had the chance to seek – and many have won – the right to the decent lives that Ernesto Galarza spent so much of his life seeking for them.

I was fortunate enough to also get to know Cesar Chavez.  I first met him when I was covering labor for the San Francisco Chronicle. It was on a hot summer night 45 years ago in the little farm town of Delano in southern California.

“Si se puede . . . It can be done . . . Si se puede.” He said it repeatedly as we talked deep into the early morning hours.

Si se puede . . . But I would not be persuaded. Too many others, over too many years, had tried and had failed to win for farm workers the union rights they had to have if they were to escape their severe economic and social deprivation. The Industrial Workers of the World who stormed across western fields early in the 20th century, had first tried organizing farm workers – and failed. Failing, too, were Communist organizers, socialists, and AFL and CIO organizers.

I was certain Chavez’ effort would be no different from theirs. Boy, was I wrong.  I had not accounted for the tactical brilliance, creativity, courage and just plain stubbornness of Cesar Chavez.

He understood that farm workers had to organize themselves, not depend on outsiders to do it. Chavez led the workers in creating a union of their own, which then sought out – and won – widespread support  from influential outsiders through boycotts and other tactics of non-violence patterned after those of Mohandas Gandhi and Martin Luther King Jr.

Chavez proved beyond doubt that the poor and oppressed can prevail against even the most powerful of opponents – if they can effectively organize themselves and adopt non-violence as their principal tactics. As Chavez explained, “We have our bodies and spirits and the justice of our cause as our weapons.”

The results of the Chavez-led organizing drives were impressive – the first farm union contracts in U.S. history, and the California law, also a first, that requires growers to bargain collectively with workers who vote for unionization.

Chavez worked closely with Dolores Huerta in creating and leading the United Farm Workers union. Huerta was, for instance, one of the principal leaders of the worldwide grape boycott that forced growers to agree to those first farm labor contracts  – which Huerta negotiated despite her lack of experience in contract bargaining.

Huerta’s work with the UFW was just a part of her lifelong and extraordinarily successful and courageous fight for economic and social justice that she waged while also raising 11 children.

Huerta’s traveled the country, speaking out and joining demonstrations for a wide variety of causes and successfully lobbying legislators for important gains for Hispanic immigrants and others.

Huerta started out as an elementary school teacher in northern California in 1955, but soon tired of seeing the children of farm workers regularly come to school hungry. That, and her anger over the injustices suffered by the local farm workers, led Huerta to quit teaching and join the Community Services Organization – the CSO – an organization founded by community organizer Saul Alinsky, with Chavez eventually serving as its General Director.

The CSO helped local Chicanos wage voter registration drives and take other actions to win a strong political and economic voice. But when the CSO’s other directors refused to agree to a union organizing drive among local farm workers, Chavez and Huerta quit to organize on their own. Like so many others, the CSO directors said it couldn’t be done. Thankfully, they were wrong and Cesar Chavez and Dolores Huerta were right.

But being right is just the first step, essential as it is. Hundreds of thousands, if not millions of poorly treated farm workers badly need to be organized, badly need the decent treatment that unionization can bring them, as it did to many others that the extraordinary efforts of Cesar Chavez, Dolores Huerta, and Ernesto Galarza helped bring to many others.
