Muni reform that might actually work

EDITORIAL The 2007 ballot measure that was supposed to give Muni more political independence and more money has failed to provide either. It’s time to say that Proposition A, which we supported, hasn’t worked — in significant part because the administration of Mayor Gavin Newsom hasn’t allowed it to work. It’s time for a new reform effort, one that looks at Muni’s governance structure, funding, and the way it spends money.

There are several proposals in the works. Sup. David Campos has asked for a management audit of the Municipal Transportation Agency, which runs Muni, and that’s likely to show some shoddy oversight practices and hugely wasteful overtime spending. Sup. Sean Elsbernd wants to change the way Muni workers get paid, and Sups. Ross Mirkarimi and David Chiu are talking about changing the way the MTA board is appointed. There are merits to all the reform plans, but in the end, none of them will work if they don’t address the fundamental fact that Muni doesn’t have enough money to provide the level of transit service San Francisco needs.

The basic outlines of what a progressive Muni reform measure would look like are pretty obvious. It ought to include three basic principles: work-rule and overtime reform; a change in the way other departments, particularly the police, charge Muni for work orders — and a sizable new source of revenue.

The work orders are, in many ways, the easiest issue. Last year, the San Francisco Police Department charged Muni more than $12 million in work orders. For what? Well, for doing what the Police Department gets paid to do anyway: patrolling Muni garages, putting cops on the buses, and dealing with Muni-related traffic issues. And a lot of that $12 million is police overtime.

The labor and revenue issues are trickier — mostly because they’re being addressed separately. Elsbernd, for example, wants to Muni workers to engage in the same collective bargaining that other city unions do, which makes a certain amount of sense. But he’s wrong to make it appear that the union and the workers are the major source of Muni’s financial problems — and that approach won’t get far. The bus drivers and mechanics didn’t make millions on large commercial developments that put a huge strain on the transit system — and the developers who profit from having bus service for the occupants of their buildings have never paid their fair share. Nor is it the fault of the union that car traffic downtown clogs the streets and makes it hard for buses to run on time.

We agree that the transit union needs to come to the table and talk, seriously, about work-rule changes. Every other city union, particularly SEIU Local 1021, whose members are among the lowest-paid workers in the city, has given something up to help the city’s budget problems.

But any attempt to change Muni’s labor contract needs to be paired with a serious new revenue program aimed at putting the transit system on a stronger financial footing — and traffic management plans that give buses an advantage over cars. The city can add a modest fee on car owners now, and if a Democratic governor wins in November, it’s likely that state Sen. Mark Leno’s bill to allow a local car tax will become law. That’s part of the solution, as is expanded parking meter hours. (And someone needs to talk about charging churchgoers for parking in the middle of the streets on Sundays.) But Muni also needs a regular stream of income from fees on developers.

And a seven-member MTA appointed entirely by the mayor does nothing for political independence; at the very least, the supervisors should get three of the appointments.

The city badly needs Muni reform — and the elements are all in place. But it can’t be a piecemeal approach.

Chiu moves to reject Muni budget

At the May 4 Board of Supervisors meeting, Board President David Chiu introduced a motion to reject the Municipal Transportation Agency budget, approved by the MTA Board on April 20.

Noting the deep service cuts that are scheduled to inflict the city’s public transportation system on Saturday, May 8, Chiu said riders could expect “longer wait times, more crowding, and people being passed up by full trains.”

Chiu has signaled his frustration with the MTA before and called for reform. “We will be having many conversations with the MTA and with the Mayor’s Office, but I do think at this time we can do better than the budget that we have in front of us,” he said.

Chiu also referenced a recently issued City Controller’s review of SFMTA work orders, conducted to find out if various city departments contracted to provide services for Muni are fairly and accurately billing the agency. The report indicated that MTA work order expenditures have been on the rise, while various city departments “did not often provide sufficient reporting documentation in their billings, and we don’t have a strong sense of whether these bills were paid appropriately for services rendered,” Chiu noted.

Accordingly, he introduced accompanying legislation requesting that the City Attorney draft legislation to implement key recommendations in the controllers’ review.

“It’s just not responsible,” said Tony Winnicker, press secretary to Mayor Gavin Newsom, when asked for a comment on the proposal to reject the Muni budget. “If they’ve got specific solutions … then that’s different. But for now it’s just political grandstanding of the worst kind, and it’s really irresponsible.”

According to section of the City Charter that deals with the public-transit system, however, the board doesn’t have the power to modify the MTA’s budget — it can only accept it or give it a thumbs down. According to Section VIII A 106 (c): “the Board of Supervisors may allow the Agency’s budget to take effect without any action on its part or it may reject but not modify the Agency’s budget by a seven-elevenths’ vote.”

What’s wrong with taxing car owners?

It’s almost as if we need a full-time blogger to monitor the backwards ideas coming from the Chron’s C.W. Nevius. Today’s case in point: Nevius thinks the idea of charging for Sunday parking is “the dumbest idea since the imitation crab meat cocktail.” 


His brilliant investigative observation:


For all the talk about the fees on Sunday turning over parking spaces, you never read very far into one of these parking enforcement stories before you get to the bottom line — an estimated $2.8 million a year in this case if the Sunday-charge system was implemented citywide.


That’s exactly right, Chuck: This is a way to bring in money for Muni. And I don’t get what’s wrong with that. People who drive cars (and I admit, I’m one of them) have an outsized impact on the city; they take up a huge amount of space (San Francisco devotes more urban land to streets than parks), they pollute the air, they increase the nation’s reliance on fossil fuels and they contribute to global warming. And they don’t pay anywhere near enough taxes and fees to mitigate the impacts of their behavior.


I’m all for higher gas taxes, for example; taxes should not just be a source of revenue but should, when possible, be targeted to discourage socially detrimental behavoir. And charging people a little money to drive their cars to Sunday brunch instead of walking or taking public transit isn’t a terribly radical, unusual or disturbing idea. (In fact, we ought to charge the churches for the right to turn the streets into private parking lots on Sunday mornings).


Nevius complains that car drivers aren’t bad:


But c’mon. These aren’t evil people. They aren’t trying to scam the city, pee on the street, or break car windows and steal backpacks. We could fine the aggressive panhandler and the petty break-in artists, but they don’t have any money.


And I agree: They aren’t bad. But the same way taxes on cigarettes both defray the social cost of tobacco use and discourage the dangerous and noxious habit, a modest little fee for parking your car helps pay for public transit and might just encourage a few people not to drive their cars. That’s something everyone in the city should support.

The San Francisco Chronicle reports that there are now almost 10,000 employees with paychecks that totaled more than $100,000 last year. I can already hear the screaming: that’s close to a billion dollars! City workers are all overpaid, fat, and lazy! That’s why we have a budget crisis!

And yeah, I think it would be a lot more fair if the highest earners took the bulk of the pay cuts (5 percent for everyone in that $100K club would be $50 million a year). But Mayor Newsom wants to be sure the lowest-paid folks get their share of the hurt, so the biggest impact of his budget reductions will fall on those least able to handle it.

But I also think it’s worth looking at who these high earners really are.

Now, some of the ones at the top of the scale are political appointees. Do we really need to pay $354,000 to get someone qualified to run Muni? Is the head of the city’s Public Utilities Commission really worth $291,000? Some are getting market rate for their skills — three of the top 20 earners are doctors who work as pathologists in the Medical Examiner’s office.

But the most telling fact is that 11 of the top 20 are either cops or firefighters — and they’re collecting huge amounts of overtime. Four cops alone, all with the rank of captain or deputy chief, accounted for overtime pay totaling $588,000.

I know city employees who work at the senior management level — just like those cops — but they don’t get overtime. Neither do senior managers in most private-sector jobs. And it’s not as if these top cops are working for minimum wage; they all make around $200,000 or more as base salary. Plus they get excellent benefits and get to retire on sweet pensions.

Think of all the money and services you could save with one minor contract change: once you get to the level of captain in the SFPD, you aren’t eligible for overtime anymore.

Those overpaid city employees? Mostly cops

The big banner headline on the front page of today’s Chronicle exposes the fact that one out of every three city employees makes more than $100,000 — great fodder for the no-new-taxes-we-pay-the-workers-too-much bunch. But it’s worth taking a second to run the full database (which sfgate has made easy for you); ask for the top 20 earners.


Here’s what you find:


Four of the top five are cops (Deputy Chief Charles Keohane, $516,000; Deputy Chief Morris Tabak, $425,000, Cpatain Greg Suhr, $345,000 and Captain Sylvia Harper, $345,000. The only civilian in the bunch is the head of Muni, Nat Ford, who has a contract paying him $354,000. What puts the top cops over the top is overtime, hundreds of thousands of dollars of overtime. Nat Ford — who also works hard, probably as many hours as a deputy chief — doesn’t get overtime. The chief of police doesn’t get overtime. Why do top-level police managers?


Okay, that’s the top five. Of the top 20, 11 are either cops or firefighters. The only civilians? The head of the Public Utilties Commission, Ed Harrington, the guy who manages investments for the city, Kavid Kushner, and three doctors who work in the Medical Examiner’s Office. Investment managers get paid pretty well in the private sector; so do pathologists, and you have to pay a fair amount to get people with those specialized skills.


And the docs put in for a combined $4,300 in OT; the retirement guy got none.


So if you want to complain about overpaid city employees, let’s be honest about where the problem starts. We’re paying far too much overtime to management-level cops and firefighters, who already make very comfortable salaries. And while it’s tough to be a cop or a firefighter, most of these senior managers are not putting their lives on the line every day busting bad guys and walking into burning buildings; they’re supervisors.


I hope all the cut-the-fat folks will keep that in mind.


 

Green cards in hand, Washingtons want Newsom to discuss immigrant youth policy. In person.

Tracey Washington and her 13-year old son heard today that their green card applications have been approved. This means that they will not be deported to Australia, and their personal immigration nightmare is over.
But even as the family rejoices, Tracey’s husband, Charles Washington, a Muni bus driver and long-term San Francisco resident, has written to Mayor Gavin Newsom, voicing disappointment over Newsom’s failure to reach out to his family during their time of need and over Newsom’s continuing refusal to implement the immigrant youth due process policy that a veto-proof majority of the Board approved, in November 2009.

“Our family’s luck n this case was unique, but Mr. Newsom, the pain we felt when our family was facing deportation as a result of your policy is not unique at all,” Washington wrote in his April 21 letter. “We share the pain felt by the many other families whose children were taken into ICE custody and ordered deported, as a result of your policy.” (The full text of the letter that Charles Washington sent to Newsom today is included at the end of this blog post.)
 
The Washingtons’ nightmare began in January, when their 13-year-old boy was reported by juvenile probation to ICE for a minor bullying incident, during which he took 46 cents from another youth, then gave it back and apologized. That’s when the family first discovered that, thanks to a new juvenile immigrant policy that Newsom implemented in July 2008, their teen was going to reported to ICE immediately after his arrest – and before his case was heard in juvenile court. 

And even though the family was eligible for green cards thanks to Tracey’s April 2009 marriage to U.S. citizen Charles Washington, ICE handed Tracey and her son their deportation orders on Feb. 5, 2010–the same day they picked the boy up from juvenile detention and used the boy as bait to get his mother to agree to wear an electronic monitoring anklet.

That anklet was finally taken off today, meaning that Tracey Washington was forced to wear this uncomfortable and humiliating device for two and a half months, even though she did not commit a crime–and even though her son was not found guilty as charged, when his case was finally adjudicated by a juvenile justice.

Following the bullying incident, local law enforcement officers charged the boy with three felony counts, triggering an immediate referral to ICE, under Newsom’s immigrant youth policy.  But a juvenile justice recently gave the boy informal probation, recognizing that the youth is a first-time offender who committed a low level offense and is a good candidate for rehabilitation.

But seven weeks ago (March 1), when Tracey and her son had exhausted their legal options and were facing imminent deportation, the five-member blended Washington family held a press conference as a last resort. Two days later, following a media firestorm, ICE granted the Washingtons a two-month reprive, so that U.S. Citizenship and Immigration Services could review and approve their green card applications.

“We really appreciate that U.S. Citizenship and Immigration Services was willing to look at our individual circumstances and approve our residency application, so that our family can stay together,” Tracey Washington said today. “ At the same time, my heart goes out to the many other families who were harmed by the Mayor’s policy.” 

Angela Chan, the staff attorney at the Asian Law Caucus, who handled the family’s case, noted that while the Washington’s nightmare ended happily, many other families continue to be broken up by harsh immigration laws, lack of access to affordable legal services, and Mayor Newsom’s local policy towards immigrant youth.

“Newsom’s policy exacerbates the impact of a broken federal immigration system on San Francisco families,” Chan said. “We need humane reform at the federal level, but in the meantime, Mayor Newsom needs to take a stand today for due process and family unity by ending San Francisco’s draconian policy. If the Washingtons’ son had not been reported to ICE, as required by Newsom’s policy, he would not have been sent to ICE, and he and his family would not have had to endure this nightmare.”

RE: Unjust Policy Regarding Undocumented Youth in San Francisco

Dear Mayor Newsom,

My name is Charles Washington. I was born and raised in San Francisco, and am a long-time resident of this great city. I also am a city employee. I love the city of San Francisco and my family has developed strong roots here. Unfortunately, last month, we went through a horrible ordeal when my wife and step-son were ordered deported as a result of your policy, which requires reporting of youth to Immigration and Customs Enforcement (ICE) right after arrest, before the youth even has a chance to have a hearing in juvenile court regarding the charges.

As you may have read in the news, my 13-year-old son was arrested and reported to ICE for deportation over 46 cents in a minor, first-time bullying case. In accordance with your policy, San Francisco juvenile probation officers reported my son to ICE before the allegations could even be adjudicated by a juvenile court judge. To my shock, my wife also was ordered deported by ICE as a result of the reporting of my son by juvenile probation in keeping with your policy.

With the imminent deportation hanging over my wife and son’s heads, we were utterly terrified that our family would be torn apart. Since we had no other legal remedies when our request for a stay of deportation was denied, we desperately reached out to the media to seek help in a last ditch effort. Fortunately, a reporter contacted the White House, which then resulted in an extension of the deadline for the deportation. However, I must tell you that during this time, we were really disappointed that we did not receive a single call or any type of outreach from your office to offer my family support, especially when my son’s referral to ICE was a direct consequence of your policy.

I also would like to express my deep disappointment in the statements your office issued after my family was granted the reprieve through no help from your office. Your office made statements to the press suggesting that our situation proves your policy leads to just outcomes. I completely disagree with this assertion and firmly believe that our being granted the reprieve has proven even more so that your policy hurts families and tears children away from their parents for minor, first-time offenses. The White House seems to understand the importance of keeping families together in granting the reprieve. Unfortunately, your office appears to have missed this completely. It is extremely hurtful to our family that you would try to claim credit for the positive turn in events that my family and the community supporting us worked hard to obtain in order to combat the injustice brought upon us by the policy you implemented in the first place.

Let me also say that my family was lucky, but there are many other families who have not been as fortunate.There was no handbook to tell us what to do to obtain a reprieve when we were in this crisis. It just so happened that we were able to obtain legal assistance, but what if we had been unable to find legal services or if the press had not covered our story? My wife and son would have been torn from me and there is nothing I could have done to stop it from happening. Families in San Francisco should not have to struggle or rely on luck to stay together. In fact, there have been over a hundred families in this city who have not been as fortunate as my family since your harsh and inhumane policy was implemented in 2008.  Our family’s luck in this case was unique, but Mr. Newsom, the pain we felt when our family was facing deportation as a result of your policy is not unique at all.We share the pain felt by the many other families whose children were taken into ICE custody and ordered deported as a result of your policy.

Mr. Newsom, I know that you are a new father yourself and will teach your own daughter many lessons in her lifetime. I respectfully ask you to reexamine your policy from the eyes of a father, the way that I am looking at my son today. While I must say that I am greatly disappointed in the actions you have taken to support a flawed policy that has endangered the children of this city, I do hope that you will take this opportunity to do the right thing and support implementation of Supervisor Campos’ due process amendment, which is now city law.  Families like mine, who are hard-working and rooted in San Francisco, are depending on you to do what is right and to follow the law the community passed in November 2009.

I respectfully request a meeting with you, in which my lawyer, Angela Chan from the Asian Law Caucus, and my family can speak with you about this policy and how it has affected us and continues to impact families in San Francisco.

MTA board approves controversial budget

City Hall needed an overflow room to accommodate all the disenchanted Muni riders who showed up to protest the two-year San Francisco Municipal Transportation Agency budget plan yesterday (4/20). The budget locks in a 10 percent service cut through July 1st, 2011, at which point the MTA board is hopeful that the service cut will be lowered to 5 percent. The controversial budget was adopted on a 4-3 vote, and now goes to the Board of Supervisors, where progressive supervisors have already signaled opposition to the service cuts.

“It still seems and feels as I look at it [the budget], that it’s very tenuously put together. In light of the fact that it’s going to impact the least, the lonely, and the lost of us, I had to say, let’s keep looking at it,” said Director James McCray, who was one of three dissenting votes.

McCray, along with Director Malcolm Heincke who voted for the budget, were the two directors to openly express concern about the pay of transit operators and overtime charges. In a $750 million budget, service cuts wound up providing $29 million in savings, a relatively small number compared to the $456 million that will be spent on salaries and benefits, as well as the $59 million in work orders to other agencies like the police department and the city attorney.

Small revenue measures like adding 1,000 metered spaces, eliminating free reserved parking around areas like City Hall, and window advertising wrap on buses are part of the budget.

Heincke questioned MTA Executive Director Nathaniel Ford about the budget which includes $10 million in labor concessions from MTA employees while locking in a $9 million raise in 2011 and a $9.5 million raise in 2012 for transit operators from Transit Workers Union (TWU) Local 250-A. Transit operators’ wages and raises are written into the city charter. 

“The bubble over my head says wow,” said Heincke. Ford’s attempts to negotiate with the union over work rules have been unsuccessful. Sup. Sean Elsbernd is pushing a charter amendment for the November ballot that would remove the TWU’s pay rates from the city charter.

Anger over Muni’s payment of work orders to other city agencies was a constant theme among community groups as diverse as the Chinese Progressive Association and the San Francisco Transit Riders Union. Those work orders have increased from $36 million in 2006 to $66 million in 2010.

“What really happened is the rest of the city had a budget crisis and the mayor went after Muni looking for funds,” said Dave Snyder, coordinator for the San Francisco Transit Riders Union. Newsom appoints the directors who sit on the MTA Board. “Muni is paying for service the public doesn’t want them to pay for at the expense of transit service.”

Members of the Latino and Chinese-American community were out in large numbers, not just to protest service cuts that they felt disproportionately impact the Mission and Chinatown, but to complain about harassment by the police. Enforcement of the Proof of Payment program has increased with Muni agents and police checking the amount of time left on riders’ transfer tickets, and issuing fines.

“You have police asking for ID and issuing $75 fines. There have been a few cases of deportation,” Beatriz Herrera, an organizer for People Organized to Win Employment Rights (POWER). Referring to riders whose transfers expire while riding a bus, Emily Lee of the Chinese Progressive Association said, “They expect folks to get off the bus. That’s an unreasonable expectation. It’s stressful for the community. The police are intimidating.”

The service changes are slated to take effect May 8th.

A new report by Chicago-based think tank Center for Neighborhood Technology (CNT) considers just that problem, offering a new way of understanding just what constitutes affordable housing.

The CNT report — dubbed the Housing and Transportation (H+T) Affordability Index (www.htaindex.cnt.org) — maps housing affordability for 337 metropolitan areas and provides before-and-after snapshots that show how affordability changes when transportation costs are taken into account.

Affordable housing is usually defined as consuming 30 percent or less of a household’s income, but CNT proposes a redefinition. Under CNT’s new definition, housing is only considered affordable if the sum of housing and transportation costs constitutes 45 percent or less of household income. That redefinition would have dramatic effects on the Bay Area’s affordability picture.

Many communities in the region that would have been considered affordable under the old definition — including large swaths of Hayward, Marin County, Sacramento, and Stockton — would be unaffordable under the new standard. And San Francisco, well served by public transit, would be deemed a lot more affordable.

The difference that smart planning and public transportation make can be huge, especially for households already feeling the pinch of a weak economy. According to CNT, transportation costs in “location efficient” neighborhoods — its term for “compact, mixed-use communities with a balance of housing, jobs, and stores, and easy access to transit” — can be as low as 12 percent of a household’s budget versus up to 32 percent for less efficient neighborhoods where residents must drive to jobs and services.

For example, CNT calculated an annual transportation cost difference of $2,780 between Oakland’s Rockridge neighborhood, which it calls “compact,” and the city of Antioch, which it considers “dispersed.”

CNT says “location efficiency” in development can translate to big savings. According to its report, if 50 percent of new growth in the Bay Area occurs in compact rather than dispersed neighborhoods, the region could collectively save more than $1.1 billion in transportation costs.

Besides reducing a community’s environmental impact and improving residents’ quality of life, the report argues that things like walkability, proximity to jobs and services, and efficient public transportation help make an area more livable and affordable. The report also raises questions about the wisdom of cutting public transportation, especially in a period when many households are being forced out of their homes.

CNT hopes that its analysis will lead to more awareness for policy makers and more transparency for consumers. “What we’re looking for is a new definition of affordability, transportation cost disclosures for consumers, and incentives to build more compact communities around transit,” CNT spokesperson Nicole Gotthelf told us.

Gotthelf said the Bay Area has been at the forefront of this issue, specifically mentioning the work of the Bay Area Metropolitan Transportation Commission (MTC), the agency that plans, coordinates, and finances transportation in the nine counties that make up the region. “They’ve been actively trying to understand the housing and transportation trade-offs for Bay Area households.”

In turn, MTC offered support for the principles behind the CNT study. “We agree that it is good policy to promote the development of affordable housing at or near transit hubs,” MTC spokesperson John Goodwin told the Guardian.

In its “Transportation 2035 Plan for the San Francisco Bay Area,” which outlines how the agency will spend $218 billion in transportation funds over the next 25 years, MTC even sets out a goal of “decreas[ing] by 10 percent the combined share of low-income and lower-middle-income residents’ household income consumed by transportation and housing.”

Goodwin told us the agency is committed to smart growth principles: “The Bay Area is not unique, but I think the Bay Area is part of a vanguard … We are among the leading metro areas in making this a policy priority, and I feel confident in saying that this priority will continue to be affirmed.”

Goodwin pointed to the agency’s Transportation for Livable Communities (TLC) program, which is designed to promote development that “revitalizes central cities and older suburbs, supports and enhances public transit, promotes walking and bicycling, and preserves open spaces and agricultural lands.” Now in its 12th year, the TLC program has helped fund scores of transportation-related and affordable housing projects.

The MTC also administers the Housing Incentive Program, which “rewards communities … when they successfully promote high-density housing and mixed-use developments at transit stops to support transit use.” The program provides up to $3 million in grants to local governments that partner with developers to build housing near transit hubs.

Conversely, the agency also won’t approve funding for new transit stops that aren’t in dense areas. The thresholds require a minimum number of housing units within a half-mile radius of new transit stops, from 750 units for new ferry terminals to 3,850 units for new BART stations.

But the MTC’s efforts represent only one part of the equation. Goodwin said that coordination is key. “What we have here in the Bay Area is that decisions about transportation funding — for the most part — are conducted at the regional level, while land-use decisions are made at the local level. So it requires coordination between regional agencies like MTC and local cities and counties.”

In spite of the MTC’s efforts, huge problems plague the region. Housing costs in the Bay Area are among the highest in the nation. A recent report conducted by the Urban Land Institute — based on research conducted by CNT — found that, on average, Bay Area households spent $41,420 a year on housing and transportation, a whopping 59 percent of median income.

With budget crises affecting many of the region’s public transit providers, service cuts and fare hikes make the picture bleaker. Recently, AC Transit and Muni services were cut by almost 10 percent, causing longer waits and crowded buses — and a huge budget deficit could mean deep cuts in Caltrain service this summer. If these cuts force more Bay Area households to turn to cars, the region’s affordability can be adversely affected, even as households deal with the pressures of a weak economy.

On the national stage, several developments offer signs that smart growth principles — including the link between housing affordability and transportation — may be gaining wider traction. These developments are presenting smart growth and public transportation advocates with opportunities to push for reform.

Last year, three federal agencies — the Department of Housing and Urban Development, the Department of Transportation, and the Environmental Protection Agency — announced a partnership that would have the agencies working together on housing and transportation initiatives. The partnership laid out six “livability principles,” including commitments to provide more transportation choices, “promote equitable, affordable housing,” support existing communities, and “value communities and neighborhoods.” The new partnership’s rhetoric includes references to location and energy efficiency, transit-oriented and mixed-use development, and walkable neighborhoods.

On Capitol Hill, Congress is working on a new omnibus transportation bill to replace a bill that expired in 2009. The bill would provide billions in federal funding for highways and other forms of surface transportation. Consideration of the new bill in both the House and Senate has stalled, but some proposals emphasize the creation of transportation choices and livable communities. Transportation for America (www.t4america.org), a coalition of housing, transportation, environmental, and other groups, is mobilizing to promote public transportation and sustainable development in the new transportation bill, seeking to make CNT’s way of looking at the world into official U.S. policy.

Chiu talks MTA reform as agency fails to support Muni

With the San Francisco Municipal Transportation Agency Board of Directors poised to approve a truly terrible two-year budget today (4/20) – one that locks in Muni service cuts, subsidizes the police and other city departments, and fails to seek new revenue sources – there is talk about reforming an agency run exclusively by appointees of Mayor Gavin Newsom.

The most significant figure sounding that call is Board of Supervisors President David Chiu, who told the Guardian that he plans to hold hearings this year on the MTA board failures to support transit service, with the goal of placing reform measures on the November ballot. Helping that effort will be his newest board aide, Judson True, who comes from a fire-tested stint as the MTA’s spokesperson and before that was a board aide to then-Sup. Gerardo Sandoval.

“We’re going to have a very serious discussion about MTA reform,” Chiu told the Guardian. “I’ve got some real questions and for the next six months, that will be front and center…I expect there to be a very robust discussion about the MTA and balancing that budget on the backs of transit riders.”

Those discussions will be wrapped into city budget season, a realm in which Chiu is also adding firepower right now by hiring Cat Rauschuber as his other new board aide. Rauschuber has her masters in public policy from Harvard’s Kennedy School of Government, most recently worked for city Budget Analyst Harvey Rose, and earlier worked in the city’s Legislative Analyst’s Office.

“It’s important that we hire folks who have experience in city government, particularly solid policy experience,” Chiu said, adding that his third board aide, Victor Lim, came from the Asian Law Caucus and has experience in immigration reform, another valuable asset given the ongoing standoff between the board and Newsom over sanctuary city policies. 

True and Rauschuber are also master networkers with strong and extensive connections in the progressive community, as well as more mainstream arts, culture, and political communities (Full disclosure: They’re also friends of mine). Those connections and social skills could help unite the varied critics of the current MTA budget, which range from the downtown-oriented SPUR to the new San Francisco Transit Riders Union (SFTRU) to the radical ANSWER Coalition, all of whom have areas of policy disagreement over the best way forward.

All are expected to weigh in today (4/20) at 2 p.m. when the SFMTA convenes in City Hall Room 400 to discuss and vote on the agency’s two-year budget. And while the groups may differ over partial solutions like extended parking meter hours, they all agree this a truly terrible budget that disproportionately punishes low-income people who rely on Muni.

“The budget is irresponsible and dishonest,” SFTRU project director Dave Snyder. “It reveals the hypocrisy in the mayor’s stated environmental commitments. This action will cut public transit permanently and that’s irresponsible.”

Mayoral press secretary Tony Winnicker has not yet responded to the accusations or to Chiu’s calls for MTA reform, but I’ll post his response in the comments section if I hear back.

FILM Che Rivera, a strong, middle-aged Latino man, approaches his son with festering anger and fury in his eyes. With outrage, he yells, “Why does this motherfucker have his tongue down your fucking throat?” as he points to a photo of his teenage son kissing another man. “Why do you think?” his son replies in a sharp tone. His rage surfacing, Che leans over, beats the boy, and forces him to leave their Mission District home.

Tackling issues of homophobia, masculinity, and violence, independent film La Mission uncovers the inner struggle of an obstinate father (Benjamin Bratt) learning to accept his son, Jesse (Jeremy Ray Valdez) for being gay. Throughout the film, Che is a dominating machismo presence. By day he works as a Muni driver who strives to keep his bus in line by fighting off difficult passengers. At night he customizes low rider cars and leads a group of friends and family through cruises in the city.

“Che is kind of the alpha male within Latino culture, as well as the alpha male in the dominant culture,” said director and writer Peter Bratt during a recent phone interview alongside younger brother Benjamin. “Something about the Latino community and having a gay son threatens the idea of being a powerful male.”

The role of Che was based on a real Mission resident, a fact that Bratt believes gives the movie more of an authentic feel. “The real Che is a larger-than-life persona. When he walks into the room, you feel his presence,” Peter said. “He’s a brown and proud Chicano who we thought represented the passion and vibrancy of the neighborhood.”

As the film unfolds, the audience starts to learn that Che is more than just a man of aggression. He also feels a strong love for his son and community, despite having a difficult time expressing that love.

“We found it intriguing to take a character like [Che] who appears to be one way and start to peel the layers back,” Benjamin explained. “A real tenderness exists. You don’t see it expressed in words or a physical action, But it comes in other forms.”

After looking back at films that portray men of color as one-dimensional, the actor decided his character would embody an array of emotions and struggles that previous stories had not explored. “When you look at a lot of representations of men of color, they’re often drawn as people to be feared,” Benjamin continued. “Che is a very familiar character that we’ve seen in cholo and urban films. We wanted to pull back the layers and actually show that there is a complex being underneath the swagger and stance.”

When it came to starting the production of the film and choosing a location, the Bratt brothers — who grew up in San Francisco — didn’t hesitate to base the story in the Mission.

“Benjamin and I had already dreamed of making a film in the Mission,” Peter said. “We know about Harlem, Brooklyn, and Queens from filmmakers like Woody Allen and Martin Scorsese. We feel like the Mission is up there with those neighborhoods. It’s just as vibrant, politically and culturally.”

In the four weeks it took to shoot the film, members of the community helped by working behind the cameras as well as in front of them. “We cast a lot of people right from the Mission, which we thought lent a certain level of authenticity,” Peter said.

Although the film takes place in a neighborhood with multiple cultures, traditions, and social issues, the Bratts believe the particular journey undertaken by their characters isn’t something everyone in the community goes through.

“There are a million and one stories going on in the Mission at any given time and this was not our attempt to create the definitive Mission story,” Benjamin said. “Our goal was to create something authentic and ultimately something that would entertain and enlighten you.” *

The problem with Park Merced

It’s no secret that Park Merced, the sorta-suburban mega-housing complex in the southwest corner of the city, wants to expand. New mid-rise towers would house some 7,000 apartments, with space for maybe 12,000 new residents — which is fine if you like the idea of more rental housing in the city (although much of it not affordable). But it also means a huge amount of new traffic in the area, particularly on 19th Avenue, which is pretty crowded as it is.


Now, the developer and the city talk about adding new transit to the area — an underground Muni rail station at Park Merced, more buses, all that good stuff. Sup. Sean Elsebernd, who represents the district, is (properly) demanding it.


But here’s the hitch: Never once in the history of this city has a major new development paid enough fees or brought enough money into the city to pay for the infrastructure required to serve it. And that’s going to get even worse if the mayor gets his way and defers development fees.


The cost of the level of transit necessary to serve the new residents of Park Merced, along with the expanded number of students at San Francisco State, and the expansion of the Stonestown shopping center, is gong to be massive. Park Merced may pay to build a new station — but the developer won’t pay for the cost of buying new buses and trains, hiring operators, and paying them. The increased property tax revenue from the project won’t cover that, either — particularly since it also has to cover water and sewer expansion, police and fire expansion, new schools and parks, and all the other expensive things that 7,000 new residents will want.


I don’t think the city’s even come close to figuring out the total bill for all the infrastructure improvements this project will require. Let’s add that up first — before the city issues any permits — and present the developer with the bill. Then we can decide if this project is a good idea.

Director Susi Damilano continues the streak with SF Playhouse’s latest, the less heavy but very funny Den of Thieves, about an unlikely foursome of inept bandits caught trying to heist a Mafioso’s safe under a discotheque in Queens — a simple tale that gives plenty of scope to Guirgis’s muscular way with dialogue and the clash of characters. The story opens on a depressed recovering kleptomaniac, Maggie (an affectingly understated Kathryn Tkel), and her 12-step sponsor Paul (the excellent Casey Jackson), a nerdy fast-talking mixed-race former safecracker, whose Jewish grandfather headed up a famous crime ring that robin-hooded their take to library construction for kids in the neighborhood. Enter Maggie’s former boyfriend, a Puerto Rican tough named Flaco (a hilariously spot-on Chad Deverman), with his new squeeze, erotic dancer Boochie (a deftly comic Corinne Proctor), and a lead on a large traceless sum of cash. Suddenly the smell of big money sends recovery out the window and makes uneasy bedfellows of the motley, hostile bunch. Enter angry but softhearted mobster Little Tuna (Ashkon Davaran), his sadistic sidekick Sal (Peter Ruocco), and big gun Big Tuna (Joe Madero). Facing mob vengeance, it’s time for some fast-talking and deal making among the mini-den, and all bets are off. The ending seems to have eluded Guirgis a little, but the way there makes for meaty comedy, while the exceptional cast sells the conceit so beautifully they make it a crime to miss. (Avila)

Just in time for the sun’s critically acclaimed debut, the Internets has once again plotted to increase our digital dependence. Google Maps now has a bicycling option!

If you’re a biker in San Francisco or Oakland, you don’t need me to tell you that you gotta pick your routes around these cities. One false move and you’re falling into the ruts of MUNI train tracks or on a freeway on-ramp (don’t laugh, it happens… to me). But no longer, or at least less often, will you have to deal with these small catastrophes.

Just type in your start and finish and the Goog has your most two wheel friendly route between A and B sorted. Sure, it’s basically an algorithm that connects the marked paths and wide shoulders easily visible on your SF Bike Map– Google’s still at beta when it comes to the ins and outs of our city’s considerable altitude changes, or our multi-tiered, if not hierarchical ways of getting the bridge and tunnelers in and out of here. A quick search for the route between my pad and my night job advised me to head up Eddy Street, which my quads tend to eschew for the less demarcated, but more planar blocks of Turk and Golden Gate. And tell the site you’re headed for a wild night out from SF to East Bay to see that new William T. Wiley showing at UC Berkeley and the site will recommend pedaling across the Bay Bridge- via the Ferry Building. But they’re trying, goddammit.

At least now your out of town houseguests won’t wind up hyperventilating on Van Ness Avenue on that loaner cruiser bike anymore. So for today, digital corporate megalith, you get golf claps- you are one step closer to becoming the website I go to for everything, all the time, always.

Top San Francisco officials are still refusing to implement legislation approved by the Board of Supervisors that requires due process to play out before immigrant youth accused of felonies are turned over to the federal government, despite recent developments that call into question arguments that have been made against that policy.

Mayor Gavin Newsom, whose veto of the legislation was overridden by the board in November 2009, has been the main obstacle to putting the new policy in place. He has argued that it violates federal law, that the city faces civil liability for harboring undocumented immigrants accused of crimes, and that only serious criminals have been affected by his unilateral 2008 decision to turn minors over to federal authorities before they have been convicted.

But then Muni bus driver Charles Washington’s wife, Tracey Washington, and 13-year-old stepson, undocumented immigrants from Australia, were placed under the control of U.S. Immigration and Customs Enforcement and ordered deported after the boy got into a fight at his middle school.

The case generated sympathetic media coverage because the felony charges and deportation order seemed excessive, so the federal government issued a 60-day reprieve to allow the family to finish applying for green cards and so the boy could have his day in juvenile court.

“All this got triggered by the non-implementation of a law that the board duly enacted last year,” Washington said March 11, a week after getting his reprieve, expressing exasperation with city officials. “The police are overcharging kids and waiting for someone else to whittle the charges down, and the probation officers are referring the kids to ICE, waiting for someone else to deal with the situation.”

Newsom’s policy required the city’s juvenile probation department to refer Washington’s stepson to federal immigration authorities after local police charged the boy with felony robbery, assault, and extortion in a dispute over 46 cents. Authorities then required his mother, rather than his stepfather, to come pick him up and placed an electronic monitoring device on her pending a deportation hearing.

Newsom’s policy has had a big impact in the city’s immigrant communities. Since July 2008 when the mayor ordered changes to Sanctuary City policies that had been in place for two decades, 125 youths have been referred to ICE, according to a March 9 report from the city’s Juvenile Probation Department.

In addition to the Mayor’s Office, the JPD has refused to enforce policies enacted through legislation by Sup. David Campos that are technically supposed to be the new city policy on referring undocumented youth, and the City Attorney’s Office has not required city employees to follow the new law, arguing it can only give advice and not compel departments to take action.

“With the benefit of legal advice provided by the City Attorney’s Office and outside legal counsel, and in light of current restrictions imposed by federal law, particularly the position taken by federal law enforcement authorities, the department has concluded that it cannot modify its policies and practices,” probation chief William Siffermann said at a March 4 hearing of the Board of Supervisors Rules Committee on why his department didn’t implement the legislation.

Grilled by Campos, Siffermann could not identify a federal law that requires city officials to report kids to federal immigration authorities upon arrest. Instead, Sifferman pointed to what many in the criminal justice community see as U.S. Attorney Joseph Russoniello’s overly broad interpretation of federal immigration laws, including his allegation that transporting arrested juveniles to court hearings amounts to “harboring aliens.”

But the Washingtons’ case struck a raw nerve at City Hall, and the Obama administration’s conciliatory response, along with other recent legal developments, indicate that it isn’t the feds that are preventing implementation of Campos’ legislation.

In February, Superior Court Judge Charlotte Woolard ruled in a civil case that the Bologna family — of which three members were murdered in 2008, allegedly by Edwin Ramos, an undocumented immigrant who had been in city custody as a juvenile — can’t hold the city liable for failing to prevent the murders.

That crime had been sensationalized by the San Francisco Chronicle, the San Francisco Examiner, and nativist groups, putting pressure on Newsom to change the Sanctuary City policy. Newsom’s spokespeople repeatedly have referred to it as an example of the civil liability the city faced.

On March 1 (the same day Washington first went public), City Attorney Dennis Herrera replied to allegations that his office has not done enough to implement Campos’ amendment by citing its victory in the Bolognas’ civil case, which sought punitive damages and to invalidate the city’s sanctuary ordinance.

Herrera also asked Gary Grindler, acting deputy attorney general at the U.S. Department of Justice, to direct the U.S. Attorney’s Office in the Northern District of California to “not use its limited resources to criminally prosecute local officials and employees who abide by California and local laws regarding the reporting of undocumented juvenile immigrants to the federal immigration authorities.”

Herrera based his March 12 request on an Oct. 19, 2009 memo that Grindler’s predecessor, David Ogden, issued curtailing federal action against medical marijuana dispensaries, which Herrera argued could serve as the model for clarifying the federal position on the city’s sanctuary law.

“If city officials and employees follow the mandates of state law, including those regarding the confidentiality of records of juvenile detainees, and the requirements of the amendment permitting the reporting to ICE of juveniles only after they have been adjudicated as wards of the court for criminal conduct, then the U.S. Attorney should not make it a priority to use its scarce federal resources to prosecute those city officials on the theory that by not reporting them at an earlier point, the city officials or employees are guilty of harboring,” Herrera wrote.

Campos said he welcomes any effort to get clarification from the feds, but believes such clarification is not necessary — and may not be forthcoming anyway. “So San Francisco should move forward. The law, in my view, allows us to do so, and it’s the right thing to do.”

Who profits from ICE’s electronic monitoring anklets?

One of the many troubling things to emerge from the threatened deportation of the wife and stepsons of Muni bus driver Charles Washington is the extent to which the Department of Homeland Security (DHS) is using electronic monitoring bracelets to track immigrants–and is turning to private contractors to deliver these services.
Take the Washingtons’ case. Charles Washington told reporters that US Immigration and Customs Enforcement (ICE) told him they would release his teenage stepson, if his wife Tracey, went to ICE’s Sansome Street office in San Francisco and agreed to wear an electronic anklet (pictured below).

Tracey Washington agreed to the deal, worried about her 13-year old son, who had spent close to a week in detention at juvenile hall, after he got into a fight at school over 46 cents, and who was now in the hands of federal immigration authorities. And she had cause to worry. The feds have been known to transfer teenage immigrants arrested in San Francisco to detention facilities in Florida, Virginia and Oregon, while their deportation is pending.
So, the Washingtons hurried down to Sansome Street to retrieve their son.  And, there Tracey Washington was given deportation orders for herself and her son, and an electronic monitoring device, which contains a GPS device to monitor her movements 24/7, was placed around her ankle.
Tracey says the device was too tight at first, and, though it has since been adjusted, wearing it makes her feel as if she has committed a serious crime. But so far, no one in her family has actually been found guilty of a crime in this Kafkaesque episode.
Instead, her 13-year-old son has been charged with felony robbery, assault and extortion, charges that sound serious but have yet to be adjudicated in a juvenile justice court, and that were made in the wake of a schoolyard fight, which did not involve weapons, after the parent of the victim called the police.
But these felony charges are the reason why a juvenile probation officer called ICE, who picked up the boy, and, within 5 hours, released him to his mother, once they’d locked an electronic monitoring device on her ankle.
As for the question of the Washingtons’ visa overstay, which is ICE’s grounds for the anklet, the couple say they called the US Citizenship and Immigration Service (US CIS), not once, but twice, two days after they got married in April 2009, when Tracey, who met Charles on vacation six years ago, was midway through a 90-day visa waiver.
The couple say they were given misinformation on the phone about the urgency of applying for a green card, and that’s how they came to be only at the beginning of that process when their son got nabbed—a lag that Charles Washington attributes to the time it took for his family to save up the thousands of dollars that green card applications cost.
And apparently there is no way for the Washingtons or the US government to verify what happened when the couple called US CIS, and spoke to an operator. US CIS spokesperson Sharon Rummery told the Guardian that it is impossible to ascertain if a contractor with the US government misinformed the family.
‘I can’t say that it’s true or not, because it was a private conversation between one of the operators who works on our customer service line,” Rummery said. “Our operators are highly trained and are backed up by our trained officers,” Rummery continued, confirming that the operators are contractors, not US CIS staff.
Either way, Tracey Washington is left wearing an anklet. And as a hard-working, bus-driving US citizen, her husband Charles is not pleased that his tax dollars are being put to use in a way that leaves his wife stressed and feeling like a criminal.

“It’s my belief they are wasting tax payer money,” Washington said, eight days after US ICE granted his wife and stepson 60-day deportation reprieve. “With all the publicity this case has received, and the fact that our green card application has been sent in, I don’t see why she needs to be on the anklet. Everything that immigration has requested, we have complied with.”

So, just how widely spread is the use of anklets to track immigrants?

In 2002, federal immigration authorities created a $3 million Alternatives to Detention (ATD) program, to ensure that “aliens released from detention appear for their court hearings,” according to a 2010 ICE report.Fast forward to 2010 and the program’s FY 2010 budget is set at $69.9 million.
And somewhere along the way, the program began requiring immigrants who are in the process of applying for residency to wear electronic monitoring ankle bracelets 24/7—a requirement otherwise reserved for rapists, child molesters and other convicted criminals on parole.
This pilot program, which began in eight cities, including San Francisco, has since grown to a nationwide multimillion opportunity for contractors and now involves at least 30 cities: Atlanta, Charlotte, Baltimore, Boston, Hartford, Buffalo, Chicago, Kansas City, Dallas, Denver, Detroit, El Paso, Houston, Los Angeles, Delray Beach, Miami, Orlando, Newark, New Orleans, New York, Philadelphia, Phoenix, Portland, Seattle, San Francisco, Salt Lake City, San Antonio, San Diego, St. Paul and Washington.
In July 2009, DHS/ICE’s office of Detention and Removal Operations (DRO) awarded a $372 million, 5-year contract to BI Incorporated, a Boulder Colorado-based company, to provide support services for its Intensive Supervision Appearance Program  (ISAP) 11, as the federal government previously called its electronic monitoring program.
G4S Government Services of Atlanta, Georgia, which held the previous ISAP’s pilot contract, and put in a S489 million bid for ISAP 11, protested the BI award, arguing that DHS’ evaluation and BI’s price proposal were “unreasonable.”
Either way, DHS’ “statement of work” documents, which were posted online as part of that contract bid, suggest that ICE plans to use ATD on an even wider basis, in future.
“Approximately, 32,000 persons are held in secure detention by DRO each day,” the contract’s statement of work (SOW) section states, noting that this figure includes “aliens in the United States who are in violation of the Immigration and Nationality ACT (INA) who pose a threat to community safety, national security, and/or may be a flight risk, in addition to those aliens required to be detained under specific provisions of the INA.”
“Limited detention capacity and an increasing detainee population coupled with the need to lower alien absconder rates have sparked national efforts over the past several years to integrate into DRO’s general practices the use of various alternatives to detention for aliens who do not require mandatory detention in accordance with the INA,” the contract continues. “Alternatives to detention offer the prospect of a considerable cost savings over secure detention for eligible aliens.”
“Depending on available funding during the execution of the ISAP 11 contract, DRO intends to expand its ISAP coverage,” the contract notes. An attached appendix shows a list of 165 cities in which the program would operate nationwide. In addition to San Francisco and Los Angeles, California cities on the list include Bakersfield, San Diego, El Centro, Fresno, Imperial, Lancaster, Lompoc, Sacramento, San Jose, San Pedro, Santa Ana, Stockton, and Ventura.
Under the current contract, BI was expected to be fully prepared with sufficient staff and equipment to fulfill all statement of work requirements for 16,750 ISAP II slots, within two months of assuming control of the program. San Francisco was expected to fill 850 of these slots, putting it in fourth place behind Los Angeles (3,400 slots), New York, (1,500 slots) and Washington, D.C., (1,025).
And by the end of the five-year contract, the numbers of slots are expected to rise to 27,237 slots—a 10,487 increase, along with a steady increase in participating cities. Under those estimates, San Francisco is expected to have 957 slots five years from now,
The federal government touts ISAP, which relies on telephonic reporting, unannounced home visits, and regular face-to-face interviews, as well as electronic GPS monitoring devices, as a “cost-effective alternative to detention for aliens being processed through the Immigration Court system.”
ICE’s Lori Haley stressed that the program, with its focus on alternatives to detention, is part of the department’s “commitment to immigration reform.”
“Our mission is to ID non-citizens here without legal status and move them through the immigration process how the court sees fit,” Haley said.
She also stressed that the anklet program is preferable to detention and is suitable for folks with families who are not posing a danger to their community.
“We also found that as people get closer to the conclusion of the process, they may need a stronger level of monitoring,” Haley added, alluding to the reaction of folks on realizing that they are going to be deported after all.
These statistics paint a perhaps surprising picture to the average American, who likely wasn’t aware that there are thousands of immigrants in the US, who haven’t committed a serious crime, yet are walking around wearing these onerous, privacy-invading devices, hidden beneath their pants, or while they shower, or go to bed, while they await a ruling from the courts on their request to stay here permanently.
And these numbers are only going to grow bigger, if ICE has its way.
“Depending how long an alien remains in the ATD program and the number of individuals enrolled in the ATD program, implementing ATD nationwide would require between $88 million and $513 million,” ICE stated in its 2010 report to Congress. “The most realistic scenario for expansion requires a reduction in the average length in the ATD program to 180 days, down from the current average of 310 days. Reducing the average length on the program requires significant coordination within the Department of Justice, Executive Office for Immigration Review.”
“310 days in an anklet” sounds like the name of a funny film. Unfortunately for the 800 people in San Francisco, including Tracey Washington, who are apparently walking around wearing these devices in any given year, the situation is not funny, but it is all too real. And is this really the way to reform the federal immigration system in a humane and meaningful way?

The story opens on a depressed recovering kleptomaniac, Maggie (an affectingly understated Kathryn Tkel), and her 12-step sponsor Paul (the excellent Casey Jackson), a nerdy fast-talking mixed-race former safecracker, whose Jewish grandfather headed up a famous crime ring that robin-hooded their take to library construction for kids in the neighborhood. Enter Maggie’s former boyfriend, a Puerto Rican tough named Flaco (a hilariously spot-on Chad Deverman), with his new squeeze, erotic dancer Boochie (a deftly comic Corinne Proctor), and a lead on a large traceless sum of cash. Suddenly the smell of big money sends recovery out the window and makes uneasy bedfellows of the motley, hostile bunch. Enter angry but softhearted mobster Little Tuna (Ashkon Davaran), his sadistic sidekick Sal (Peter Ruocco), and big gun Big Tuna (Joe Madero). Facing mob vengeance, it’s time for some fast-talking and deal making among the mini-den, and all bets are off. The ending seems to have eluded Guirgis a little, but the way there makes for meaty comedy, while the exceptional cast sells the conceit so beautifully they make it a crime to miss. (Avila)

In fact, this devised work, directed by Mark Jackson and beautifully brought to life by an exceptional student cast from SF State’s theater department, conveys not just the poetry but the sheer energy, surprise, and shock of living — at the very heart of the work — better than any recent straight-ahead production in recent memory. This vibrant, movement-based, and repeatedly stunning postmodern Juliet retains the dramatic arc of Shakespeare’s tragedy, yet runs another parallel arc of its own, exploring the perspective of Juliet as an extremely intelligent, vital and growing young woman by ingeniously refracting her through the lives and memories of seven actors, six female (Arisa Bega, Charlotte Gulezian, Meredith, Frannie Morrison, Megan Trout, Mai Kou Vang) and one male (Dara Yazdani). The results are not to be missed, providing something truly unique as well as one of the most compelling ways into a text that refuses to die despite a million bad productions. The flight is occasion for Frannie’s own flights of memory, exotic behavior in the aisle, and unabashed advances toward the flight deck brought on by the seductively confident strains of the captain’s commentary. The singular personality and mother-daughter relationship that unfurls along the way is riotously demented and brilliantly humane. (Avila)

Try to ask someone who’s ever felt marked by the color (any color) of their skin if they believe in a post-racial society, and see what kind of a response you elicit. That there is no tidy answer to this potentially messy question is a conundrum well-illustrated by playwrite Chinaka Hodge’s hypothetical fable of a white-skinned baby born into an African-American family. Each member of the family has a different reaction to and relationship with the mysterious blonde-haired changeling Miranda, dubbed "Random". Her father, who dies when she is young, is reported to have hated her. Her oldest brother Watts (Daveed Diggs) claims to understand her best, but in trying to get her to unravel what it means to be "black" vs. "white", reveals himself to be as confused as anyone by the lack of a single definition. Her mother Willie—played tough and no-nonsense by Margo Hall (who also plays the teenaged Miranda)—loves her unconditionally, yet ultimately sacrifices her for the well-being of the greater family unit. Hodge’s first full-length play, Mirrors succeeds in strong performance, warm humor, and crackling, poetic dialogue, but fails to adequately resolve how it is that the otherwise uncompromising Willie lets the low card of an unfortunate accident trump her otherwise strong hand of "colorblind" maternal loyalty. Why Muni is in such trouble

OPINION The Municipal Transportation Agency’s Web site states a goal of providing a "convenient, reliable, accessible, and safe transit system that meets the needs of all transit users" in San Francisco. I have a feeling that if you ask most Muni riders, few would use those words ("convenient," "reliable," "safe," "meeting the needs of all transit users") to describe Muni today.

Riders have been put in the untenable position of paying higher fares for less service. Yet Muni still faces a $17 million deficit (projected to grow to $55 million next year), which it proposes to close by again increasing fares and cutting services. When asked about Muni recently, Mayor Gavin Newsom pointed to a $179 million reduction in state funding as the culprit. And while no one can dispute the devastating impact of such a cut, there are a few questions that suggest that the state alone is not to blame for Muni’s troubles.

For one, we just learned that the MTA has not had a management and performance audit since 1996. Although it’s undergone a number of fiscal audits, a management audit is different; such an audit would actually evaluates Muni’s operations to determine if the system is run effectively and efficiently. How is it that an $800 million operation can go for 14 years without that type of evaluation?

Moreover, what does it say about how Muni is managed when the agency has consistently failed to control overtime costs? We just learned that Muni accounts for about half of the city’s overtime expenses. This fiscal year alone, Muni has spent $23.8 million in overtime, or 45.6 percent of the city’s total. What kind of management and operational practices allow an agency to function like this?

And why is Muni spending 9 percent of its budget ($67 million) on work orders (with other departments) for services that may or may not have much to do with its mission — including $12.2 million for the Police Department, $8.5 million for the Department of Telecommunications, and $6.9 million for the General Services Agency that runs 311? Since a quarter of the value of these work orders would suffice to wipe away its deficit, what, if anything, has Muni done about this?

And speaking of Muni’s deficit, why is it that increasing fares and reducing services seem to be the only tools in its tool box? As a number of transportation experts have suggested, there are several options that should have been on the table — raising parking fees, adding parking meters, charging for blue placards, and putting a revenue measure on the ballot, just to name a few. While some of these options may not be the answer, has Muni at least considered them? Did it consider them before proposing more fare increases and service cuts, including doubling fares for seniors, the disabled, and youth?

All this points to a more fundamental question — what about the MTA Board? Has the board provided the type of engaged and independent oversight needed to guarantee effective management? And is independent oversight even possible when all board members are appointed by one person, the mayor?

Because of these and other questions, I am proud that the Board of Supervisors unanimously approved a motion I introduced asking the budget analyst to conduct an independent management audit of the MTA. Given the timing of the budget process, the first phase of the audit will be completed by May 1, with the remainder in the summer. The audit will evaluate key areas of Muni’s operations to shed light on whether it is truly following best practices. We owe it to the ridership to face these questions head on. We no longer have the luxury to wait for the state to do the right thing.
