The corporation that ate San Francisco

For the past decade, Florida-based megadeveloper Lennar Corp. has been snatching up the rights to the Bay Area’s former naval bases, those vast stretches of land that once housed the Pacific Fleet but are now home to rats, weeds, and in some places, low-income renters.

When the Navy pulled out of Hunters Point Shipyard in 1974, it left behind a landscape pitted with abandoned barracks, cracked runways, spooky radiation laboratories, antique cranes, rusting docks, and countless toxic spills.

A quarter century later, Lennar came knocking at the shipyard’s door — and those of other military bases abandoned in the waning days of the cold war — recognizing these toxic wastelands as the last frontier of underdeveloped land in urban American and an unparalleled opportunity to make big money.

Lennar had already won its first battle in 1997, seizing control of the Bay Area’s former military pearl in Vallejo when it was named master developer for the old Mare Island Naval Shipyard. Two years later it almost lost its bid for Hunters Point Shipyard when a consultant for the San Francisco Redevelopment Agency recommended giving the development rights to the Ohio-based Forest City.

Lennar fought back, calling on politically connected friends and citing its deep pockets and its track record at Mare Island.

A parade of Lennar supporters, many of them friends of then-mayor Willie Brown and Rep. Nancy Pelosi, told the Redevelopment Agency commissioners that Lennar was the only developer that had bothered to reach out to the Bayview–Hunters Point community. In the end, the commissioners — all of them mayoral appointees — ignored their consultant’s advice and voted for Lennar.

Nobody knows if Forest City would have done a better job. A developer is, after all, a developer. But Lennar’s victory at the shipyard helped it win the rights, four years later, to redevelop Treasure Island — long before it had even broken ground at Hunters Point. And a couple years ago, it parlayed those footholds into an exclusive development agreement for Candlestick Point.

Now the Fortune 500 company, which had revenues of $16.3 billion in 2006, does have a track record at the shipyard. And that performance is raising doubts about whether San Francisco should have entrusted almost its entire undeveloped coastline to a profit-driven corporation that is proving difficult to regulate or hold accountable for its actions.

Sure, Lennar has provided job training for southeast San Francisco residents, set up small-business assistance and community builder programs, and invested $75 million in the first phase of development. That’s the good news.

But on Lennar’s watch, a subcontractor failed to monitor and control dangerous asbestos dust next to a school at the Hunters Point Shipyard, potentially exposing students to a deadly toxin — despite promising to carefully monitor the air and control the construction dust.

And when the homebuilding industry took a nosedive last year, Lennar reneged on its promise to provide needed rental housing on Hunters Point — saying that its profit margins were no longer good enough to make rentals worthwhile. All of which raises questions about whether this company, which is working with Mayor Gavin Newsom to build a stadium at the shipyard to keep the 49ers in town, really has San Francisco’s interests in mind.

Bayview–Hunters Point native Dr. Ahimsa Porter Sumchai, a physician and a Sierra Club member, called the Lennar deal the "dirty transfer of the shipyard." She told us, "There is no reason why I’d trust Lennar more than I would the Navy and the federal regulators who have stringently worked on the cleanup of Hunters Point Shipyard, and yet it still remains toxic."

"This is just a play to get the shipyard," said Porter Sumchai, whose father was a longshore worker at the shipyard and died from asbestosis.

Part of the problem is systemic: the Redevelopment Agency hands over these giant projects to master, for-profit developers — who can then change the plans based on financial considerations, not community needs. And while Lennar likes to tell decision makers of its massive size and resources, the actual work at these bases has been delegated to limited-liability subsidiaries with far fewer available assets.

In this case, Lennar experienced a 3 percent drop in sales last year, a 29 percent increase in cancellation rates on homes, and a 15 percent dip in its fourth quarter profits. The downturn prompted Lennar’s president and CEO, Stuart Miller, to identify ways to improve what he described in the annual report as the company’s "margin of improvement" in 2007. These included "reducing construction costs by negotiating lower prices, redesigning products to meet today’s market demand and building on land at current market prices."

A Lennar spokesperson, Sam Singer, issued a statement to us saying that "Lennar BVHP is committed to operating responsibly, continually incorporating best community and environmental practices into our everyday business decisions."

But for a look at how Lennar’s model clashes with community interests, you need go no further than the edge of the site where Lennar has been digging up asbestos-laden rock.

DUST IN THE WIND


The Muhammed University of Islam is a small private school that occupies a modest flat-roofed hilltop building on Kiska Road with a bird’s-eye view of the abandoned Hunters Point Shipyard. This year-round K–12 school is affiliated with the Nation of Islam and attracts mostly African American students but also brings in Latino, Asian, and Pacific Islander children, many of whom have had problems in the public school system and whose parents can’t cover the cost of a private school.

"We find a way," the school’s mustachioed and nattily dressed minister, Christopher Muhammed, recently told the Redevelopment Agency in a veiled allusion to the financial nexus between the MUI and the Nation of Islam’s mosque and bakery on Third Street. "Many students aren’t members of our tradition but live across the street, down the street, or come from Oakland and Vallejo."

The minister is asking the Redevelopment Agency, the agency that selected Lennar and oversees the project, to permanently relocate the school. The school’s classrooms and basketball courts sit on the other side of a chain-link fence from Parcel A, which is the first and only plot of land that the Navy has certified at the shipyard as clean and ready for development.

Standing on these courts, the children have been able to watch heavy machinery digging up and moving huge amounts of earth in preparation for the 1,600 condos and town houses that Lennar wants to build on this sunny hillside, which has views of the bay and the rest of the shipyard.

The shipyard’s other five parcels are still part of a federal Superfund site, despite having undergone years of decontamination. Black tarps cover piles of soil that have been tagged as contaminated, and recently, radiological deposits were found in the sewers and soil. The Navy is still cleaning up a long list of nasty toxins, including PCBs and solvents, on Parcels B through F, the land Newsom now wants the city to take over so that it can hastily build a stadium for the 49ers.

But the minister’s request to relocate the MUI isn’t inspired by fear of Navy-related contamination or the impact of a stadium on the neighborhood but rather by the reality that asbestos is naturally present in this hillside and Lennar’s excavation work on the other side of the school’s chain-link fence has been kicking up dust for almost a year.

It’s not that Lennar and the city didn’t know about the asbestos. In April 2000 the environmental impact report for the shipyard reuse noted, "Because asbestos-containing serpentinite rock occurs at Hunters Point Shipyard, construction-related excavation activities could cause chrysotile asbestos associated with serpentinite to become airborne, creating a potentially significant impact to public health and safety."

So when Lennar proposed demolishing abandoned housing and roads and grading and transferring massive amounts of earth on Parcel A, the Bay Area Air Quality Management District demanded an asbestos dust mitigation plan that included sweeping and watering the construction sites and making sure that vehicle tires are washed before drivers exit.

The state Asbestos Air Control Toxic Measure also stipulates that if a school lies within a quarter mile of a construction site, local air districts can require developers to install asbestos dust monitors and shut down their sites whenever asbestos registers 16,000 fibers per cubic meter. The state requires these extra steps because children have higher metabolisms, growing lungs, and longer life expectancy. Plus, they’re lower to the ground and are likely to run, skip, hop, and play ball games that kick up dust.

Although Lennar agreed to abide by the air district’s requirements, the developer failed to properly implement this plan for more than a year.

The air district’s records show that Lennar’s environmental consultant, CH2M Hill, failed to include any air monitoring in its original plan for Parcel A, which is odd because the school is obvious to anyone who visits the site. It was only when the air district pointed out the existence of the Hunters Point Boys and Girls Club, the Milton Meyer Recreation Center, and the MUI, all within the quarter-mile limit, that Lennar agreed, at least on paper, to what the air district describes as "one of the most stringent asbestos dust mitigation plans in the state."

The plan combines the air district’s asbestos requirements with the city’s demands that Lennar limit "ordinary dust" that can cause respiratory irritation and aggravate existing respiratory conditions, such as asthma and bronchitis. Lennar agreed to implement the plan in the summer of 2005 and determine background levels of dust and toxins at the site before work began in the spring of 2006.

But that didn’t happen. For 13 months there is no data to show how much asbestos the MUI students were exposed to, neither for the 10 months before construction started on the cleared site nor for the first three hot and dusty months when Lennar’s subcontractors began massive earth-moving operations next to the school.

You’d think that after these failures became public knowledge, a devastated Lennar would have gotten a black eye and perhaps fired the subcontractors involved. Failing to protect children in a community that’s been the repeat victim of environmental injustice is a public relations nightmare, particularly in a part of town where distrust of redevelopment runs deep, thanks to the travesties in the Fillmore in the 1960s, followed by the city’s recent rejection of a referendum to put the Bayview–Hunters Point Redevelopment Plan to a public vote.

But while Lennar’s executives finally did the right thing last August by alerting the air district and replacing CH2M Hill, they didn’t release their two other subcontractors, Gordon Ball and Luster, nor did they sufficiently rein them in when violations continued, critics have testified at agency meetings.

And instead of apologizing to the air district and the city’s Department of Public Health for making them look like impotent fools, Lennar executives pushed back, contending that asbestos monitoring wasn’t necessary until May 2006 and that they didn’t need to water the tires of private vehicles.

They even listed economic rationalizations for the screwups that did happen. According to a memo marked "confidential" that the Guardian unearthed in the air district’s files, written by the air district’s inspector, Wayne Lee, Lennar stated, "It costs approximately $40,000 a day to stop grading and construction activity" and "Gordon Ball would have to idle about 26 employees on site, and employees tend to look for other work when the work is not consistent."

Meanwhile, the Department of Public Health was left reeling. Environmental health director Dr. Rajiv Bhatia told us, "It was very disappointing. We worked very hard. We wanted this system to be health protective. Whenever things don’t work, it takes time to get back to levels of trust. This hurts trust and credibility."

In September 2006 the air district issued Lennar a notice of violation for the period of July 14, 2005, through Aug. 3, 2006. Lee wrote that vegetation removal on the site "disturbed the soil and in some cases, likely resulted in dust." He also made it clear that "any track onto common roads could be tracked out to public thoroughfares and create asbestos dust plumes."

Lennar’s fines have yet to be determined, but they could reach into millions of dollars. State fines for emitting air contaminants range from $1,000 a day, if the violation wasn’t the result of intentional or negligent conduct, to $75,000 a day, if the conduct was deemed willful and intentional.

But as the air district weighs the evidence, one thing’s for sure: this wasn’t an isolated case of one set of monitors failing or one subcontractor screwing up. This case involves numerous violations and three subcontractors, two of which — Gordon Ball and Luster — are still working next to the MUI (neither company returned our calls).

Records show that once Lennar fired its environmental compliance subcontractor, CH2M Hill, properly installed monitors immediately detected asbestos dust, triggering 15 health-protective shutdowns during the course of the next six months. From these results, is it reasonable to conclude that had Lennar got its monitoring right from the beginning, further shutdowns would have cost Lennar’s construction subcontractors even more truckloads of money, as would have adequate watering of the site, which they didn’t get right for months?

So far, the only explanation for the watering deficiencies has come from Kofi Bonner, president of Lennar Urban for Northern California, who told the Redevelopment Agency, "Given the hilly terrain, it can only be watered enough so as not to create difficult conditions for the workers going up and down the site."

Lennar didn’t finally start to really control its subcontractors until January, when Lennar ordered Gordon Ball and Luster to "replace two site superintendents with new personnel who must demonstrate environmental sensitivity in conducting their work," according to public records.

MIAMI VICE


Headquartered in Miami Beach, Fla., Lennar began in 1954 as a small home builder, but by 1969 it was developing, owning, and managing commercial and residential real estate. Three years later it became a publicly traded company and has been profitable ever since, spinning off new entities.

Lennar Urban is one such venture. Established in 2003 to focus on military-base reuse, Lennar Urban recently produced a glossy brochure in which it proclaimed, "Military base reuse is our business — this is what we do."

Military-base development may be good business — but it isn’t always such a good deal for cities, particularly when communities don’t end up receiving what was promised on the front end.

In November 2006, Lennar announced it wouldn’t build any rental homes in its 1,600-unit development at the Hunters Point Shipyard. The Redevelopment Agency had originally approved a plan for 700 rental units on the 500-acre site, but Lennar said rising construction costs make rentals a losing investment.

Also in November, Arc Ecology economist Eve Bach warned the Board of Supervisors that Lennar’s public-benefits package for Treasure Island could be seriously compromised.

The package includes 1,800 below-market affordable housing units, 300 acres of parks, open space and recreational amenities, thousands of permanent and construction jobs, green building standards, and innovative transportation.

Bach summed up these proposals as "good concepts, uncertain delivery" and noted the discrepancy between Lennar’s stated desire for a 25 percent return and Budget Analyst Harvey Rose’s conservative prediction of an 18.6 percent return.

"Particularly at risk of shortfalls are transit service levels, very-low-income housing, and open-space maintenance," Bach warned.

With community benefits up in the air, high profits expected, and Lennar’s ability to regulate developers uncertain, many community activists question just what San Francisco is getting from the company.

"I can’t say that Lennar is trustworthy, not when they come up with a community benefits package that has no benefit for the community," activist Marie Harrison said. "I’d like to be able to say that the bulk of our community are going to be homeowners, but I resent that Lennar is spoon-feeding that idea to folks in public housing who want a roof over their heads and don’t want to live with mold and mildew but don’t have jobs or good credit or a down payment. I’ve heard seniors say, ‘I can’t even afford to die.’ Lennar is not being realistic, and that hurts my feelings and breaks my heart."

SHOE-IN


The story of Lennar and Muhammed University of Islam underscores the problems with a system that essentially relies on developers to regulate themselves. Bay Area Air Quality Management District records show officials didn’t know monitoring equipment at the site wasn’t working until August 2006, when Lennar discovered and reported the problem.

Lee reported after an Aug. 31, 2006, meeting with CH2M Hill staff, "They were not confident that the air sampling equipment was sampling correctly, due to faulty records and suspect batteries. CH2M Hill staff discovered depleted batteries and could not determine when they drained."

The air district’s air quality program manager, Janet Glasgow, told the Guardian, "The district had never been in this situation before, in which a developer, Lennar, came in and self-reported that they discovered a problem with their monitoring — something the district would never have been able to determine."

Worrisome as Glasgow’s statement is, there’s also the possibility that CH2M Hill’s failures might never have come to light had it not been for the city’s decision to demand another layer of dust controls. As Department of Public Health engineer Amy Brownell said, her inspectors were witnessing trails of dust firsthand, yet CH2M Hill’s monitors kept registering "non-detect" around asbestos.

"Which was suspicious," Brownell told us, "since they were doing massive earthwork."

Saul Bloom, who is executive director for Arc Ecology, a local nonprofit that helps communities plan for base closures and cleanups, told us he recalls "waiting for the first shoe to drop, wondering how there could be no work stoppages when Lennar was digging up a hillside of serpentinite."

The other shoe did drop shortly after the August 2006 meeting. It was black and well polished and attached to the foot of Muhammed, who began questioning whether the dust wasn’t harming his students.

But Muhammed found his questions weren’t easy to answer, given that Lennar had failed to monitor itself and therefore lacked the data that could have proved no harm was done, a scary situation since health problems from asbestos exposure don’t generally manifest themselves until many years later.

Those questions raised others about Lennar and whether it should be trusted to self-regulate.

DÉJÀ VU


In December 2006, Redevelopment Agency Commissioner Francee Covington asked Lennar’s environmental manager, Sheila Roebuck, if the company had any asbestos issues at other projects in the nation. Roebuck replied no, not to her knowledge.

But the Guardian has learned that Lennar already had problems with naturally occurring asbestos in El Dorado. The problems concerned dynamiting in hills that were full of naturally occurring asbestos and resulted in a $350,000 settlement in November 2006. The case involved two El Dorado Hills developers, Angelo K. Tsakopoulos and Larry Gualco, and their earthmoving subcontractor, DeSilva Gates Construction of Dublin.

As part of the terms of the settlement, the county agreed, at the behest of the developers, to make their earthmoving contractor, DeSilva Gates, who provided the dynamite, solely responsible for the settlement. Accused of, but not formally charged with, 47 violations of air- and water-pollution laws is West Valley, a limited liability company composed of Lennar Communities of Roseville, Gualco, and Tsakopoulos’s AKT Investments of Sacramento, with Lennar managing the LLC and AKT acting as the investor.

But as the Sacramento Bee‘s Chris Bowman reported, El Dorado Air Quality Management District head Marcella McTaggart expressed her displeasure directly to Lennar Communities, writing, "We are very disappointed to note that the agreed-upon measures to minimize … dust were completely disregarded by your company."

McTaggart’s words bear an eerie resemblance to Bhatia’s comments about how Lennar’s failure to protect the public heath "hurts trust and credibility."

"Ultimately, I’m very interested in being able to talk to the families and children who believe they have been harmed," Bhatia told us. "I want to help with people’s uncertainties and fears."

LEGAL PROBLEMS


Uncertainty and fear were on display at the Redevelopment Agency’s December 2006 meeting when Muhammed claimed that serpentinite, arsenic, and antimony had been found on his students and staff through "resonance testing."

Lung cancer experts doubt that methodology, telling us the only way to detect serpentinite in bodies is by doing an autopsy.

Following the minister’s claims, a rattled Bonner told the Redevelopment Agency, "Lennar cannot continue to be accused of covering something up or willfully poisoning the community because of profits. Lennar is a national public company, and the accusations and allegations are very serious."

Unfortunately for Lennar and the city, the company’s failures to monitor and control dust have left both entities exposed, since they formed a limited liability company without extensive resources, Lennar BVHP, to conduct the shipyard cleanup.

This exposure became even more evident when Muhammed returned to the Redevelopment Agency Commission in January with 15 MUI students in tow to ask for a temporary shutdown of Lennar’s site until a permanent relocation of the school had been worked out.

"It doesn’t seem proper to have peace discussions while the other side is still shooting," Muhammed said.

His relocation request got Bayview–Hunters Point community activist Espanola Jackson raising more questions: "OK, but where are the other residents going? How can you displace them? Have the residents on Kiska Road been notified? Or on Palou? Nope. You give people dollars to do outreach, but they don’t come to my door. Someone is being paid to not give the truth."

Scott Madison, a member of the Hunters Point Shipyard Citizens Advisory Committee, who’d observed large excavation machines breaking rock but not using water or any other dust controls, said, "I don’t understand how Lennar, who I believe has a sincere interest in doing right, can continue to have a contractor who is out of control."

Bonner explained that Lennar sent notices of default to its subcontractors and hired people from the community to be monitors, plus installed a secondary level of consultants to monitor contractors. But when Redevelopment Agency commissioner London Breed expressed interest in releasing the old contractor and hiring a new one, the agency’s executive director, Marcia Rosen, chimed in.

"Our agreement," Rosen said, "is not with the subcontractor. Our agreement is with Lennar." Her words illustrated the agency’s impotency or unwillingness to crack the whip over Lennar and its subcontractors. But when Lennar Urban vice president Paul Menaker began to explain that its contractors have a 10-day cure period, it was too much for Commissioner Covington.

"We’re way past that," Covington exploded. "We’re not hams!"

EXPLODING HAMS


Perhaps they’re not hams, but the commissioners’ apparent inability to pull the plug on Lennar or its subcontractors leaves observers wondering how best to characterize the relationship between the agency, the city, the community, and Lennar.

Redevelopment Agency commissioners have been appointed either by Mayor Gavin Newsom or his predecessor, the consummate dealmaker Willie Brown. But the incestuous web of political connections goes even further.

Newsom is Speaker of the House Nancy Pelosi’s nephew by marriage. Newsom’s campaign treasurer is another Pelosi nephew, Laurence Pelosi, who used to be vice president of acquisitions for Lennar and now works for Morgan Stanley Real Estate, which holds Lennar stock.

Both Newsom and Laurence Pelosi are connected to lobbyist Darius Anderson, who hosted a fundraiser to pay off Newsom’s campaign debts. Anderson counts Lennar as his client for Treasure Island, Mare Island, the Hunters Point Shipyard, and Candlestick Point, another vast swath of land that Lennar controls.

Brown’s ties to the agency and Lennar run equally deep, thanks in part to Lennar’s Bonner, who was Brown’s former head of economic development and before that worked for the Redevelopment Agency, where he recommended hiring KPMG Peat Marwick to choose between Catellus, Lennar, and Forest City for the Hunters Point project.

KPMG acknowledged all three were capable master developers, but the commission decided to go with the most deep-pocketed entity.

Clearly, Lennar plays both sides of the political fence, a reality that suggests it would be wiser for cities to give elected officials such as the Board of Supervisors, not mayoral appointees, the job of controlling developers.

DAMAGE CONTROL


Under the current system, in which Lennar seems accountable to no one except an apparently toothless Redevelopment Agency, you can’t trust Lennar to answer tough questions once it’s already won your military base.

Asked about asbestos at the Hunters Point Shipyard, Bonner directed the Guardian‘s questions to veteran flack Sam Singer, who also handles PR for Ruby Rippey-Tourk. Singer tried to dodge the issue by cherry-picking quotes, beginning with a Dec. 1, 2006, letter that the city’s health director, Dr. Mitch Katz, sent to Redevelopment’s Rosen.

Katz wrote, "I believe that regulatory mechanisms currently in place for Shipyard Redevelopment are appropriate and adequate to protect the public from potential environmental hazards."

The assessment would seem to be at odds with that of Katz’s environmental health director Bhatia, who has been on the frontline of the asbestos fallout and wrote in a Jan. 25 letter, "The failure to secure timely compliance with the regulations by the developer and the repeated violations has also challenged our credibility as a public health agency able and committed to securing the regulatory compliance necessary to protect public health."

Singer also quoted from a Feb. 20 Arc Ecology report on asbestos and dust control for Parcel A, which stated, "Lennar’s responses have been consistently cooperative." But he failed to include Arc’s criticisms of Lennar, namely that its "subcontractors have consistently undermined its compliance requirements," that it has "not exercised sufficient contractual control over its subcontractors so as to ensure compliance," and that it was "overly slow" in implementing an enhanced community air-monitoring system.

Singer focused instead on Arc’s observation that "there is currently no evidence that asbestos from the grading operation on Parcel A poses an endangerment to human health and the environment."

Lack of evidence is not the same as proof, and while Arc’s Saul Bloom doesn’t believe that "asbestos dust is the issue," he does believe that not moving the school, at least temporarily, leaves Lennar and the city liable.

"They formed a partnership, protective measures didn’t happen, the subcontractors continue to be unreliable, and dust in general continues to be a problem," Bloom told us.

Bloom also recommends the Redevelopment Agency have an independent consultant on-site each day and bar contractors who screw up. "Without these teeth, the Redevelopment Agency’s claims that they have enforcement capabilities are like arguments for the existence of God."

Raymond Tompkins, an associate researcher in the Chemistry Department at San Francisco State University and a member of the Remediation Advisory Board to the Navy who has family in Bayview–Hunters Point, says what’s missing from the city’s relationship with Lennar is accountability, independence, and citizen oversight.

"If you can’t put water on dirt so dust doesn’t come up, you can’t deal with the processes at the rest of the shipyard, which are far more complicated," says Tompkins, who doesn’t want the Navy to walk away and believes an industrial hygienist is needed.

"The cavalier attitude around asbestos dust and Lennar at the shipyard fosters the concerns of the African American community that gentrification is taking place — and that, next stop, they are going to be sacrificed for a stadium." *

Dear Mom:

I have to admit I’ve been letting your question sit here in my "good question!" file for months. As a newish mother myself, I can’t easily write about this without taking it a bit personally too. I generally try to avoid getting all me-me-me unless it’s particularly amusing, but sometimes it can’t be helped.

Of course it seems related to breast-feeding. It is deeply and inextricably connected to breast-feeding, a process involving sex- and sexuality-related hormones, intimate touch, and boobs. So really, how could it not affect your sex life? Not to say that postpartum libido issues (I hesitate to call them problems since they are so natural, normal, and expected if generally unwelcome) are purely hormonal. You may be a big bag of hormones, but you’re a specific, unique sack of hormones living a unique and specific life. You have a husband, and you have rather a lot of children. There’s a lot more going on than the mere release or reception of this molecule or that.

I’ve read a ton on this subject, if not before I had these kids, then certainly since. And while most of what you see out there is common sense or nonsense, there are a few bits and bobs you may not have heard. Not everyone knows, for instance, that we all release the milk-making hormone prolactin after orgasm, producing a sensation of satiety. Even fewer people will have heard about the researchers who recently measured prolactin levels in laboratory subjects who masturbated to orgasm or had penis-vagina sex to the same end. The screwers released 400 percent more prolactin than the wankers did, possibly explaining why most people find partnered sex more satisfying than masturbation. Much work remains to be done (what about other kinds of sex with a partner? What about homo sex?), but if we in the Lactation Nation are already walking around with high levels of prolactin, which of course we are, we may already be feeling the sort of satiety that other, less milky people have to have partnered sex in order to achieve. We don’t want sex because we feel like we just had some, and the drive to go get some more is suppressed. That’s one theory, anyway.

Breast-feeding also releases oxytocin, that busy hormone with jobs ranging from stimuutf8g uterine contractions and causing your husband to start snoring so soon after sex to making prairie voles (and perhaps everyone else) bond to a partner and stick around to raise the children together. The oxytocin released at orgasm is responsible for the aaaaahhhh feeling you get as you nestle back into your beloved’s arms. It creates similar warm fuzzies at the mere touch of the right person (good hugs release oxytocin, while unwanted or merely social hugs do not). Oxytocin, of course, is released as your baby nurses, but also by just cuddling with her (or in some cases thinking about her). Again, the sensations of calm, happy, shmoopy-pie satiety, while delightful, are not exactly conducive to going out and gettin’ you some.

Add to all this the fact that your usual sex drivers, estrogen and testosterone, are at an all-time low, and the chemical basis of the "just don’t wanna" that can last as long as you keep up the nursing becomes obvious. Add to that the sleep deprivation, the ambivalent (to put it mildly, also inaccurately) feelings that many of us harbor about the changes our bodies have gone through, and the vaginal dryness, and there ya go. Death of sex. For a while. Do not despair.

Here’s my big secret program, which I hope to make some bucks selling to desperate couples: Do not feel guilty. Guilt kills sex. Do not hide or contrive to fall asleep before or after your husband, and do not lie or make excuses. All of these set up a familiar but deadly teenagerish dynamic where you own the sex but won’t be doling much, if any, out. Meanwhile, your husband is skulking around like a starving mongrel trying get whatever scraps you might drop in an unwary moment. Yuck and ew. You are grown-up partners, and you’re on the same side. Do not forget this.

Face your husband, clear-eyed. Remind him that it’s hormonal. Remind him that it will end. Encourage him to keep offering, since your proposition circuits are down at the moment. And — really important — if it doesn’t sound unappealing, take him up on it sometimes. Just because you didn’t crave it doesn’t mean you won’t enjoy it. Eventually, you’ll even want it, as long as you don’t have a bunch of stupid fights about it first.

Law enforcement’s real battles

OPINION In order to be smart on crime, law enforcement needs to make important choices about where to focus our resources. Unfortunately, the Bush administration has been making poor choices, and those choices are hitting home in San Francisco.

Recently, Immigration and Customs Enforcement (ICE) has conducted raids in San Francisco and around the Bay Area, rounding up immigrants at their jobs and schools, in some instances with ICE agents announcing themselves as police. These actions sow fear in the immigrant community among undocumented and documented residents alike.

The raids conducted in San Francisco present many of us in local law enforcement with a great concern. One of law enforcement’s biggest challenges to protecting crime victims in immigrant communities is encouraging them to come forward. Because immigrants are often afraid to report crimes, they can be regarded as easy targets for violent criminals and con artists.

We all suffer when crime victims are isolated from law enforcement. If victims and witnesses do not report crimes or cooperate with law enforcement, criminals remain on the streets, and all of us are put at risk. That is why my office is holding immigrant resource fairs in the Mission District and Chinatown to support immigrant rights and to make clear to community members that they are protected by San Francisco’s Sanctuary Ordinance and that my office will not report them to ICE when they come forward as witnesses or victims of crime. Rather than driving immigrants deeper into the shadows, we need to encourage those who have been victimized by crime to work with us to hold criminals accountable.

At the same time, the US Justice Department is walking down an ominous path by threatening journalists with prison time when they protect their confidential sources. In San Francisco the US attorney has held journalist Josh Wolf in prison since September 2006. Wolf should be released. For very good reasons, 31 states, including California, have shield laws upholding the rights of journalists to protect the secrecy of their sources and unpublished information. We need a federal shield law as well.

Of course, I believe crimes against police officers should be aggressively prosecuted. But I also believe that federal authorities have an obligation to respect the First Amendment. Free speech rights are critical to the work of journalists, university researchers, organized labor, and all of us in a democracy. The Justice Department should recognize the importance of protecting free speech, not only as constitutional and civil liberties issues but as smart public safety policy. Journalists play a key role in connecting us to individuals with information about crimes, and threatening the confidentiality of their sources has a chilling effect. If sources fear their confidentiality will not be protected, they will be less likely to come forward to journalists with information that could expose corruption or assist us in solving violent crimes.

Cities across the country are grappling with serious gang violence. Precious resources should be focused on addressing violence, gun crime, and major white-collar crime, not wasted on prosecuting journalists and conducting immigration raids that sweep up innocent residents, actions that hinder our efforts to build trusting relationships with vulnerable, victimized communities and keep the public safe. *

The rise and fall of the Donnas

The Donnas have every right to be bitter — and the general nonexistence of delectable male groupies is just one item on a laundry list of spoilers. "Seriously, if there were hot guys throwing themselves at me, I would take advantage of them!" complains vocalist Brett Anderson, lounging on the patio outside engineer Jay Rustin’s Sherman Oaks recording studio, where the Donnas are recording their next album.

What’s the issue on this mild winter day in an intensely girly garden paradise cluttered with poodle-haired pups, dive-bombing hummingbirds, and wildly whistling songbirds? The unequal treatment undergone by one of the most celebrated and derided groups of female rock musicians to hit the country’s pop radar since the Go-Go’s. Essentially, "it’s not the same!" Anderson and guitarist Allison Robertson yelp simultaneously.

"It’s much harder for a girl to get a blow job," adds Robertson, ever the analytical Donna, even in matters of quickies. "A lot of guys on the road in rock bands don’t always bang every girl — they just get blow jobs really fast. Guys can do that. It takes 10 minutes or five minutes. But with girls, it’s just not the same. We all know — it’s a little more involved. You need a little more privacy usually, I dunno."

Their tour bus just has tiny bunks shielded by curtains. "Literally, a Porta Potty is more private than a bunk," says Anderson, still the wisecracking, immaculately turned-out amazon in a sweater, skinny jeans, flats, and Springsteen T.

Once Palo Alto’s misfit all-girl rockers from Jordan Middle School, San Francisco’s punk-metal-pop sweethearts on Lookout!, then Atlantic’s up-and-comers splashed all over MTV, the Donnas are now, 13 years along, veterans at the ripe ages of 27 and 28 who can say they’ve been and done that and seduced, if not 40 boys in 40 nights, then thousands of listeners. Today labelless, off their well-worked and beloved touring circuit, and working through a Saturday on a disc with nary a flunky pushing a pop agenda, the Donnas are free, though their trajectory has been tough — littered with put-downs (some said they were the products of a Svengali in the form of Radio Trash–Super*Teem label owner Darrin Raffaelli, who initially collaborated with the teen band once called Ragady Anne then the Electrocutes), innuendo (who could ignore the unsettling amounts of older stalker dudes at their shows?), and rumor. "A lot of people think we’ve gotten dropped and we owe [Atlantic] thousands of dollars and we can’t pay them back!" Robertson explains. "Also that we’re broke and we’ve broken up."

"Also that we’re lazy," Anderson jumps in, imitating an imaginary slurring, boozy Donna. " ‘Oh yeah, we’re working on our record. Gimme another beer!’ "

Contrary to conjecture, it turns out that the Donnas weren’t dropped from Atlantic but left amicably, deciding not to renew in the face of pressure to go more pop after 2002’s Spend the Night failed to take off on rock radio despite much MTV play for their video "Take It Off" and 2004’s Gold Medal failed to remedy matters. "Our big joke was that we were making Gold Medal so Spend the Night would go gold," Anderson quips. Fortunately, the women who once aced their high school courses and recorded their first 7-inches after hours at a local Mailboxes Etc. are used to driving themselves — even when they couldn’t operate a motor vehicle.

"They started when they were in seventh grade," Anderson’s mother, Bonnie, says over the phone from Palo Alto. She’s one of a contingent of Donnas parents including Robertson’s musician dad, Baxter, and bassist Maya Ford’s English instructor father, John, who founded Poetry Flash. "We had to drive. We were the roadies. Mostly we drove them to different shows, unloaded them, watched them, and went, ‘Omigod,’ and loaded ’em up again. We lived vicariously through them."

But then, the Donnas’ career has been marked by such disjunctions: they were the good students who got into UC Santa Cruz (Robertson and Ford), UC Berkeley (Anderson), and NYU (drummer Torry Castellano) as well as sexy, nice girls-gone-bad who foregrounded female desire, fast tempos, and crunchy metal-fleck glam rock licks, fashioning a sound that might have emerged from Rikki Rockett and Vince Neil if they took the rock train to the next gender. All appetite and attitude, riding the tension between the needs to please and be pleased, the Donnas projected the carefree party-hard image that presaged Andrew W.K. while undergoing their share of trauma and drama, starting with a car accident on the cusp of 2001’s Turn 21 (Lookout!) and continuing through the trouble-plagued Gold Medal sessions, which saw Castellano’s painful case of tendonitis, Anderson’s ravaged vocal chords, Robertson’s divorce, and ordinarily prolific lyric writer Ford’s dry spell. "I kind of ran out of ideas and just got depressed," Ford says on the phone in Los Angeles. "I think I felt, like, a lot of pressure, and it’s never a good situation to be under the gun."

But the Bay Area–bred band stuck together, even when they always felt like outsiders amid Lookout!’s East Bay punk scene. "The thing that’s the most impressive about the Donnas is that through all of this, being teenagers, being best friends, having dreams of school and different careers, parental pressure to pursue those, highs and lows in terms of record sales and attention, they’ve stuck together," says manager Molly Neuman, once the drummer of riot grrrl groundbreakers Bratmobile and a force behind the now-catalog-driven Lookout! alongside her ex-husband, Christopher Appelgren.

The frustrating thing — even on this Grammy weekend, as the Dixie Chicks were getting ready to receive their dust collectors across town — was hitting the wall on rock radio as so many other female bands have. All the while they were dancing backward, away from the on-air jokes about synchronized periods and D-cups and being told repeatedly, " ‘We don’t play female rock on our rock station,’ " unless it’s Evanescence or No Doubt, Robertson says.

After trying Atlantic’s pop strategy and working with songwriters such as Dave Stewart ("You write songs with a guy who’s had these number one hits, and you see he still has to sit and go, ‘Dog, no. Frog, no’ — that’s nice," Anderson says. "You feel like, ‘Oh shit, he has to do that too’ "), they’re hoping to strike a balance with the new record, cooking up hard rock ear candy that satisfies a craving for sweet riffs and hard-to-shake hooks without falling prey to the monochromatic hardness of, say, Spend the Night. The songs they’ve tracked so far focus on Donna favorites — partying and dancing — with glances at the equalizing effects of nightfall and the loneliness of the road. And perhaps the gumption that gave these women the courage to face prove-it punks and surly sods every night on tour, the same sassiness that some mistake for brattiness, has been tempered with time.

"We were listening to old records and thinking, ‘Shit! Like, we’re scary!’ " Anderson says, laughing.

"This album," Robertson says softly, "is more like ‘Come party with us.’ " *

Fighting the Monster

On Valentine’s Day, Yi Jun Huang, a smiling 65-year-old Chinese immigrant, walked into the Apple store near Union Square and handed the manager a large chocolate heart and a pink valentine as about 40 laid-off Monster Cable workers and their supporters rallied outside. It was one of several appeals to electronics stores to honor a boycott and stop carrying Monster products.

Huang had worked in a Monster Cable factory producing high-end audio cables for 16 years and was fired last October with more than 120 mostly Chinese immigrant workers when the company decided to outsource their jobs.

"The production manager openly told us that production was moving to Mexico," Huang said.

Now, despite a boycott launched by the Chinese Progressive Association (CPA), a slew of protests by the workers, and a resolution passed Feb. 13 by the San Francisco Board of Supervisors urging the company to address worker concerns, Monster Cable still refuses to budge.

"A multibillion-dollar company should not springboard off their workers for the sake of profit and then kick them to the curb," said Shirley Lorence, an organizer with Rise Up, a caucus within the United Food and Commercial Workers International Union. "That’s wrong."

The recently laid-off workers have an average tenure of eight years, with many having around 15 to 20 years, according to the CPA. Many workers are in their 40s and 50s. With these layoffs, Monster Cable broke from its previous policy of providing four weeks’ severance pay plus one week for every year of service, and it did not offer job placement, retraining, or community support for any of the workers.

The Board of Supervisors resolution asks Monster Cable, which spent $6 million buying the naming rights to the city-owned Candlestick Park, to give $2 million for a Worker and Community Transition Fund and its workers a more generous severance package.

"The problem of outsourcing is something we have to make a statement on," said Sup. Jake McGoldrick, who sponsored the resolution, which passed 8–3, with Sups. Michela Alioto-Pier, Sean Elsbernd, and Ed Jew in opposition.

Elsbernd took issue with asking a company to provide a more generous severance package than what the city itself offers. Jew thought the city was being too hard on a native company in a competitive field.

Leon Chow, chair of the CPA, was very disappointed that Jew, being the only Chinese American on the board, opposed the measure. He and others said Monster appears to be financially healthy and the outsourcing was based simply on greed.

"We saw no evidence that times are tough," Huang said. "We know their sales are up to a billion dollars annually. We’re the ones who work there, and there have been no signs that things are slowing down."

But CEO, or "Head Monster" as he calls himself, Noel Lee wrote in a Feb. 9 letter to the board, "We have to yield to the competitive nature of the marketplace where global sourcing is the norm." *

The next mad rush to the sky

EDITORIAL For much of the history of this newspaper, the battle to keep San Francisco from turning into another Manhattan was a defining element in local politics. It had all the makings of urban drama: shifty-eyed developers looking to make a fast buck, sleazy politicians willing to bend over in any direction for campaign cash, a corporate power structure devoted to greasing the path for unlimited growth, citizen activists revolting over the block-by-block destruction of their neighborhoods … all played out on the stage of one of the world’s greatest cities.

We watched while Joe Alioto moved forward with redevelopment south of Market and office buildings downtown in the early 1970s. We joined anti-high-rise activists twice in ballot measure campaigns to slow the building boom, without success. We saw Dianne Feinstein push through in just a few short years more new office space than in all of downtown Boston, an entire new city of glass and steel towers — and we helped promote the campaign to slow down with Proposition M in 1986.

We exposed the fundamental lies behind the developers’ arguments by demonstrating that intensive office development cost the city more in services than it provided in revenue, reporting on how the boom would drive up rents, choke the streets with traffic, overwhelm Muni, and create ugly canyons where there were once human-scale business districts.

Then we showed that all those new buildings weren’t even creating jobs.

In the 1990s we spoke out against the economic cleansing that came with the dot-com boom.

But of late, the development battles have shifted a bit. Progressives, who were once united against downtown growth, are a bit more slippery around the latest construction boom, because this time the massive skyscrapers are set to be filled not with corporate offices but with housing. And in San Francisco today, it seems difficult for almost anyone to be against new housing.

But it’s time to take a hard look at the new rush to the sky.

When the folks at the Planning Department talk about the new urban area that’s being discussed for South of Market, they use words such as "slender, graceful towers." The idea: high-rises aren’t that bad if they’re less bulky; that way, they don’t interfere with view corridors and don’t block out the sun. In fact, the way some planners are talking about these new buildings is almost rapturous — tall condo complexes, they say, will stop suburban sprawl, prevent global warming, create exciting new neighborhoods and public spaces, and give new definition to the city skyline.

But let’s look at what they’re really talking about here.

There are, at the moment, at least 11 new buildings either proposed, under construction, or in the planning pipeline in South of Market that would bust the city’s current height limits. (And those limits are hardly skimpy — in most areas they range from about 350 to 500 feet.) And that’s just the start: the Planning Department is moving quietly to substantially raise height limits in a broad swath of San Francisco, making way for the biggest high-rise rush since the 1980s.

If the move succeeds, the skyline will develop what the Planning Department calls a new "mound" south of downtown, anchored by at least one building 1,000 feet high (almost a third taller than the Transamerica Pyramid). A single slender tower is one thing; when you put more than a dozen (and they aren’t all slender) in a cluster, you get a wall — a wall that cuts the city off from the bay, shatters the natural topography of the area, and frankly, makes the city feel less like a community and more like a concrete jungle.

Just look at the picture on this page, part of a graphic presentation the city planning staff has put together. That hardly appears to be a few shapely structures. It’s a huge new conglomeration of New York–style high-rises, and they don’t fit in San Francisco.

And what’s the point of all this? The way the developers and their allies would have us think, this is all about solving the city’s housing crisis and creating vibrant new neighborhoods. But take a look at what sort of housing is being proposed here.

All the new high-rises the Planning Department is reviewing will contain what’s known as market-rate housing. That translates to condos selling for prices far beyond the reach of most San Franciscans. So far, not one developer has agreed to put a single unit of affordable housing in the new towers; all of them plan to meet the city’s demands for below-market units by building cheaper apartments somewhere else. The new neighborhoods are going to be nothing but very wealthy enclaves, the equivalent of vertical gated communities. Families who are being driven out of San Francisco by high housing costs won’t find refuge here; the housing is designed for singles, childless couples, retired people — and world travelers who want a nice San Francisco pied-à-terre.

Is this really the kind of new neighborhood the city ought to be creating?

Then there are the economics of this madness. Providing the infrastructure for all these new residents (and we’re talking more than 10,000 new residents in this one part of town alone) will be expensive — and if anyone really thinks that development fees will cover those costs, they haven’t paid attention to four decades of San Francisco budgets.

Environmentalists and urban planners these days love to talk about density, about building more residential spaces in urban cores. That’s the best alternative to suburban sprawl: Dense neighborhoods encourage transit use and walking. Housing near workplaces translates to less driving, less pollution, less congestion.

All of which is fine and actually makes sense. But density doesn’t have to mean 80-story buildings. North Beach, for example, is a very dense neighborhood, one of the densest urban areas in the United States. It’s also a wonderful neighborhood, with open space, friendly streets, and a human-scale feel.

And it’s a diverse neighborhood: everyone in North Beach isn’t young, single, and rich. There’s a mix of rental and owner-occupied housing and, despite years of brutal gentrification, still something of a demographic mix. It’s a place that feels like a neighborhood. This new conglomeration of high-rises won’t be.

If, indeed, San Francisco wants to add 10,000 or 20,000 or 30,000 new residents, they don’t have to live 1,000 feet above the ground. There are ways to do density — on perhaps a slightly less massive scale — that don’t impact on the views, skyline, and economics of the rest of the city.

But city officials need to ask some tough questions first. Why are we doing this? Are we rezoning South of Market to meet the needs of developers and high-profile architects, or is there a real urban plan here?

The answer seems alarmingly simple right now. Dean Macris, who led the Planning Department in those awful high-rise boom years under Feinstein, is at the helm again, and although he’s supposed to be an acting director, he shows no sign of leaving. The department is in full developer-support mode — and that has to end. The Planning Commission needs to hire a new director soon, someone who understands what a neighborhood-based planning vision is about.

Meanwhile, most of this new rezoning will have to come before the supervisors, and they need to start holding hearings now. This is a transformation that will be felt for decades; it’s sliding forward way too fast, with way too little oversight. And it needs to stop. *

Wolf needs a Shield, and so do you

With the Chronicle reporters off the hook, what’s going to happen to jailed freelancer Josh Wolf? News that a mediator has been brought in is a ray of hope. But people should not forget that Wolf’s credentials as a journalist have been repeatedly challenged, and even mocked, by the US Attorney’s Office. What’s particularly disturbing is that all this is going down against a backdrop of increased media consolidation. How many journalists have full time jobs? How many photographers? How many can even afford to make journalism their full -time job? Sure, journalism is a profession for which you can get credentialed up the kazoo, but the truth is that many great reporters and videographers are self-taught, and/or are freelancers, working their craft in between another job, and rarely and barely getting paid for their labor. And what about the person who sees something going down, and picks up a notebook or camera, and faithfully records it? Many a great career started that way.
Right now, Rep. John Conyers has a bill in the works that would define a journalist as someone who is engaged in gathering and reporting on news, written, photography, video, regardless of whether the person was paid for their work or not and regardless of what media they published in. Maybe you’re reading this and thinking of extra categories and definitions that need to be included in the bill. If so, great: now would be the perfect time to speak out. That way, we can get a federal shield law that will give news gatherers the strongest protections possible. The last few years has been a really dark Dark Age for the press. Let’s free Josh Wolf and get a free press, while we’re at it.

Too many big buildings

Housing is now being stuffed into downtown blocks, more than 7,000 units in the stretch running from Market Street to the Bay Bridge. This means less driving, less subdivision sprawl and fewer car-dependent office parks in the outer ‘burbs, all worries that older high-rise foes had.

EDITORIAL Actually, no.

There are indeed a lot of new housing towers under way in San Francisco, some of them soaring to heights that will block the sun and sky and wall off parts of the city from its waterfront. But there’s not a lot of evidence that they’re doing much to cut down driving and office parks.

In fact, when we went and visited a few of these spanking new buildings a year ago, we found that few of the residents actually worked in downtown San Francisco. They were mostly young Silicon Valley commuters who slept in their posh condos at night but got up in the morning and drove their cars (or in some cases, rode vanpools) to jobs at office parks or car-dependent corporate campuses 20 to 30 miles south.

There were a few former suburbanites around — but again, they weren’t San Francisco workers. They were retired people with plenty of cash who wanted to move back to town after the kids left home.

As Sue Hestor reports in "San Francisco’s Erupting Skyline" on page 7, the Planning Department is quietly but aggressively moving to raise the height limits around the edges of downtown, particularly in the South of Market area. There’s been little protest, in part because so many of the new towers are largely for housing, not offices.

Some of the giant new buildings are very much the same sort of projects we — and much of progressive San Francisco — have been fighting against for 30 years. The Transbay Terminal will be anchored by a 1,000-foot-high commercial building that will soar far above the Transamerica Pyramid. But somehow activists seem willing to accept high-rise housing in a way they would never tolerate offices — if it’s presented as a cure to sprawl.

But that requires a big leap of faith: you have to accept that San Franciscans who will walk or take transit to work are going to wind up living in those buildings. And since much of the housing is going to consist of very high-end condos — in the million-dollar range — that almost certainly won’t be true.

The new wave of development has tremendous problems and needs far more careful scrutiny than it’s getting. The Planning Commission ought to demand a demographic study to determine whether this housing actually meets the city’s needs — and put a halt to it if it doesn’t. *

Whoa, that’s a lot of highrises

I know that we’re all supposed to love urban density these days, and even Sup. Chris Daly likes tall buildings, but at a certain point, you have to say:

Holy shit. This is way too much.

Check out the presentations here, from a recent SF CIty Planning Commission discussion on development around the new Transbay Terminal and Rincon Hill. Forget the early stuff; click down to around page 39 of the pdf and look at how this part of the city is going to look and feel.

I’m still one of the loney dissenters: I don’t think the days of the highrise wars are over, and I don’t buy the notion that we have to accept ever-higher towers that turn the city even more into a jungle of steel canyons that block out lihgt and sun. And I don’t think these “slender” towers that city planners love to talk about are going to be anything but urban blight once you get too many of them in the same place.

And I wonder why we’re doing all of this when the stated premise — to create more urban density instead of sprawl — is such a provable lie. We are building housing for people who will drive or take vanpools to big-money jobs on the Peninsula. We are encouraging car-based commuting and office-park sprawl by building an urban bedroom community for high-paid young workers who want a San Francisco lifestyle but have jobs somewhere else. That and jet-set pied-a-terres for wealthy retirees and world travelers.
We are giving up human-scale neighborhoods and views of the Bay for a a failure of a housing policy.

Hell of way to plan a city.

Will 49er tailgating burn the Alice Griffith Housing Project?

Residents of the Alice Griffith Housing project were a tad upset when they learned that Mayor Gavin Newsom’s retooled effort to stop the 49ers from dumping San Francisco could involve their homes being demolished. A resolution that came before the Board the day before the Mayor’s Sex scandal hit, included the surprising news that over the past 18 months developer Lennar, working in cooperation with the 49ers and the City, had created a preliminary plan that would provide a world-class stadium 49ers stadium and related mixed-use development. This development would consist of about 6,500 housing units, including affordable units and the replacement of the Alice Griffith Public Housing Development.
According to a letter from Newsom that was included with the Feb. 6 Board of Supes package, “The city and the Bayview in particular will benefit from extensive jobs and economic development opportunities, over one thousand units of affordable housing–including replacing the Alice Griffith housing project for the benefit of Alice Griffith residents.”
The problem was that Newsom hadn’t share this vision with the Alice Griffith residents and the few that showed up to the Feb. 6 Board meeting, which took place during the workday, expressed outrage at being left out of the loop.
As one lady said, waving a copy of the resolution in one hand, as she pounded the public comment lectern with the other “It’s not OK to have this in here without my input.”
Another, a single mother with four kids, recalled having to fight for four years to get into the project, in the first place. “I don’t want you guys to knock it down,” she said.
As Lavelle Shaw of the Alice Griffith Tenants Association told the Guardian, ” a lot of things seem to be going in through the back door. We want to be at the table for the replacement housing. And it can’t just be affordable. We want it to be low-income.”
As a result of all this uproar, Sup. Sophie Maxwell demanded a hearing, during which the resolution was reworded, reports Shaw, to give AG residents greater input. That said, Shaw urges folks to show up at the Feb. 13 Board of Supervisors meeting, to express their feelings, fears and desires.

Daly Cleans Up Dirt

No wonder District 6 Sup. Chris Daly wants to clean up election finance dirt.
Last November, the Golden Gate Restaurant Association, the Police Officers Association, the Building Owners and Managers Association and San Francisco SOS participated in massive independent expenditure campaigns in a dirty and ultimately unsuccessful effort to unseat District 6 Sup. Chris Daly.
These dirty tricks included push polls that planted nastily negative ideas about Daly, such as he hates the police–smears hat were then followed by what Daly’s aide John Avalos describes as “robocalls from Mayor Gavin Newsom,” plus mailers featuring pictures of Daly that make him look like he’s crazily shouting at the police. Nice.
These kinds of hit jobs were financed by money that originated from GGRA, POA, BOMA, and SFSOS.

The straight story on the armory

The sale of the former National Guard armory on Mission Street has caused a flurry of concern about the plans for the site of the new owner and developer, Kink.com. Most of the columns and editorials in the San Francisco Chronicle, Examiner, and BeyondChron.com have been reactionary and politically opportunistic. It has given the cheerleaders of runaway market-rate development a new reason to knock affordable housing advocates in general and the Mission Anti-Displacement Coalition in particular.

For the past six years, MAC, with the participation of hundreds of Mission District residents, has been developing a vision for the neighborhood, called the People’s Plan, which confronts the gentrification pressures of new development and sets out policies for a healthy, sustainable community. Our approach is not that of knee-jerk NIMBYs mindlessly opposing any proposed change in our community. We are in favor of affordable housing, good-paying jobs for immigrants and working-class families, and sustainable economic development.

However, immediately after the Kink.com story broke, writers such as Ken Garcia blamed MAC for directly causing the sale to what other papers are calling a “porn production company.” It’s true that MAC has opposed the previous three development proposals, but the developers themselves, responding to the ups and downs of the market, ultimately dropped the projects for financial reasons. Here’s a brief review:

In 2000 a multimedia office complex proposal was approved by the Planning Department and later dropped. The armory was then going to be a server farm. The server farm was approved by the Planning Department again (contrary to what Garcia has written), but the company went under. A local financier retained control and proposed an outlandish and financially risky housing proposal.

The luxury housing proposal went into the planning process, and an environmental review had begun, but instead, the owner sold the site to Kink.com

MAC didn’t know the owner was secretly negotiating the sale of the armory. Had the financiers been honest with the community, perhaps the city or some other entity could have come forward and put the armory to better use. But at this point, the sale of the armory is complete, and there’s no further process necessary for the new owners to set up shop. That means it’s difficult for the community or city to stop the proposed use.

Now the community finds itself responding to this purchase and to opportunists who are taking advantage of this situation to use the current plan as a wedge issue to attack MAC and other affordable housing activists who have had concerns about high-end market-rate housing development in the Mission. The Mission is both the heart of the Latino community in San Francisco and home to other communities. For a healthy and sustainable community, a measuring stick for a development project is whether it will lead to displacement of residents and community-serving businesses and contribute to gentrification.

MAC will continue to fight for equitable development through the People’s Plan and the Mission rezoning process and will continue to challenge all projects that have the potential to negatively impact our community. *

Records unsealed in a federal civil suit last week show that the Hearst Corp. and MediaNews Group have grown intensely fond of each other during the past several years. Hearst even considered selling its San Francisco Chronicle to MediaNews in 2005, but CEO Dean Singleton wasn’t offering nearly enough money.

What the records don’t show is any effort by the two chains to compete in the market by improving their products.

The Guardian first posted a story online Jan. 31 detailing court documents unsealed by Federal Judge Susan Illston in real estate investor Clint Reilly’s antitrust suit against Hearst, MediaNews, and a group of other newspaper companies who joined Singleton in a Northern California partnership that has given him control of almost every big daily in the Bay Area except the Chronicle.

The evidence of anticompetitive behavior is so clear now that the obvious question is whether the US Justice Department or the California Attorney General’s Office, with new boss Jerry Brown, will do anything about it.

Gina Talamona, a Justice Department spokesperson in Washington, DC, confirmed that the feds were still looking into Hearst’s alliance with MediaNews, but she wouldn’t, of course, divulge details.

"I’m just confirming generally we’re looking at it, and we look at the anticompetitive effects of a proposed transaction, and that’s ongoing," Talamona said. "Obviously, our folks are aware of what’s going on in that private suit, but I wouldn’t have anything further for you on that."

Illston, meanwhile, has made it clear in the past that she could force MediaNews to give up some of its newly purchased properties if Reilly convinces her that the deal violates antitrust laws.

Among the documents we obtained is a deposition of Hearst senior vice president James Asher, taken by Justice Department lawyers last September, in which he candidly explains how Hearst for years has wanted to invest in MediaNews — which likes to buy up all the papers in a region and cut costs by sharing facilities and stories.

Hearst executives "formed a favorable impression of Dean Singleton and his company" all the way back in 1995, when a shady deal in Houston gave Hearst’s Houston Chronicle a dominant position in that market after MediaNews shuttered the Houston Post and sold its assets to Hearst. Since then, Asher stated, Hearst has quietly waited for an opportunity to invest in MediaNews or at least cut costs by joining ad, distribution, and printing operations with the ostensible competitors across the bay.

That opportunity arose when Hearst claims it was most needed.

Hearst spent three-quarters of a billion dollars buying the San Francisco Chronicle in 2000, a messy deal that nearly left its old property, the San Francisco Examiner, in shambles. But the purchase quickly became a drag on the company’s portfolio.

Hearst has since lost $330 million trying to figure out how to make the Chronicle profitable. Of all the documents reviewed by Guardian so far, which include memos between Hearst and MediaNews executives outlining potential collaborations, little time appears to have been spent determining how the product itself could actually be made more valuable to readers and, hence, more lucrative for both companies. Instead, Hearst seemed hungry to emulate Singleton or at least buy a bunch of his stock and let him handle the dirty work.

The infamous Singleton strategy includes clustering properties (its Bay Area cluster is now the company’s largest), slashing staff, outsourcing jobs, and consolidating business offices. Layoffs have already occurred at the San Jose Mercury News and the Contra Costa Times, and reporters are covering stories for several papers under a single "MediaNews Staff" byline.

While Hearst lawyers told Illston early in Reilly’s suit that its $300 million investment in MediaNews, consummated last summer, would involve only non–Bay Area properties to avoid conflicting interests, executives were telling another story behind the scenes.

"The proposed transaction is an opportunity to invest at a reasonable price in a company we have admired," Hearst president and CEO Victor Ganzi wrote to Hearst’s board of directors last July. "If we are able to convert the investment to common stock in all of MediaNews, we will be able to participate in the efficiencies MediaNews will achieve through the consolidation of the Bay Area newspapers other than the San Francisco Chronicle. Whether or not we are able to convert our investment, the proposed transaction provides additional impetus for lawful cooperation between the San Francisco Chronicle and the Bay Area newspapers, which will be owned or controlled by MediaNews, in areas such as distribution, national advertising and the Internet."

Several hundred pages of records were originally filed under seal in Reilly’s suit, but the Guardian, along with the East Bay nonprofit Media Alliance, intervened to have the filings opened to public access. Attorneys Jim Wheaton, David Green, and Pondra Perkins of the First Amendment Project did the legal work.

Illston agreed with our request and made most of the records available in an order last month. Reilly’s suit is expected to go to trial in the spring. He’s alleging that Hearst, MediaNews, and its other business partners, including the Stephens Group and Gannett Co., conspired to divide and monopolize the Bay Area newspaper market.

At the very least, Asher admitted in his deposition that Hearst saw media consolidation as one of the few reasons to bother staying in the newspaper biz. Originally, Hearst executives were considering a $500 million investment in MediaNews, but that amount was eventually lowered.

"We’re among the larger owners and operators of newspapers," Asher stated. "We still believe in them, notwithstanding their challenges, and we would like to participate in that consolidation. And, in fact, if we don’t choose to, we should probably think about exiting the business." *

The benefits of fiber

Amsterdam is building a citywide fiber-to-the-premises system. So are Hong Kong, Milan, and Zurich. If San Francisco follows suit, it would be making a far-sighted, multifaceted investment: FTTP would boost our economy, attracting software companies, video production houses, and digital media shops. It would enhance public health, allowing surgeons to review the same materials from different locations. Municipal fiber would improve public safety, facilitating the mirroring and backup of vital data at remote, earthquake-safe locations. It would enable unlimited and open communications — breaking ongoing communication monopolies — and save buckets of cash within a couple of decades.

These futuristic findings are laid out in the fiber feasibility report Sup. Tom Ammiano commissioned two years ago, but the Department of Telecommunications and Information Services didn’t green-light it until last fall. As a result of this delay, the city’s Maryland-based consultant, Columbia Telecommunications Corp. (CTC), couldn’t complete its fiber study until after Mayor Gavin Newsom said he’d struck a wi-fi deal with the Google-EarthLink partnership that still requires the Board of Supervisors’ approval.

Newsom’s plan was threatened even before his recent scandals. City budget analyst Harvey Rose’s report on municipal wi-fi offered a scathing assessment of the Google-EarthLink deal. Board members will now weigh the two new reports — and the opinions of a growing number of critics of the deal — before deciding on the mayor’s wi-fi proposal.

"So far I have more questions than answers," Sup. Aaron Peskin said of trying to digest the budget analyst’s report. "Questions about free service and quality of service. Questions about the environmental and aesthetic impacts of installing antennas citywide. I’ve got questions about Google’s cooperation with a totalitarian government overseas. I’ve got questions reutf8g to the shitty service I’ve personally gotten from EarthLink. Questions about the municipalization of services and questions about other technologies, including fiber."

Peskin admitted he’s yet to read the fiber report, which lauds FTTP as "the holy grail of broadband" while explaining that wi-fi isn’t a competitor but a complement to fiber, since wi-fi’s key advantage is its "mobility and connectivity during movement."

That said, the report recommends building citywide fiber, which it describes as a "fat pipe all the way into the home or business." In the face of the public sector’s lack of interest in building fiber networks that would meet growing demands for bandwidth and speed in an equitable and affordable manner, the CTC report concludes that municipal fiber would rank San Francisco among the world’s most far-sighted cities "by creating an infrastructure asset with a lifetime of decades that is almost endlessly upgradeable and capable of supporting any number of public or private sector communications initiatives."

With fiber allowing numerous competitors to quickly and inexpensively enter the market and offer competing, differentiated broadband services and access, the report recommends a wholesale open-access model to facilitate "democratic and free market values" and enhance the city’s reputation "for visionary and pioneering projects."

The report estimates a citywide open-access wholesale model will cost $563 million but predicts it will spark economic investment and jobs. It recommends building a pilot network in a 12-square-mile economic development area that includes Bayview, Hunters Point, South Bayshore, Chinatown, the Mission District, Mission Bay, Potrero Hill, SoMa, the Tenderloin, and the Western Addition.

The study also observes that aside from supporting safety and communications systems (thereby saving the city huge and unending costs of leasing circuits from telephone companies) and providing higher quality, higher capacity, more reliable, securer service, fiber is the best backbone for wi-fi systems.

Or as communications activist Bruce Wolfe recently told the Guardian, "Wi-fi is a parasite looking for a wire."

Speaking to us, along with United Layer’s Tim Pozar, SFLan’s Ralf Muehlen, and Our City’s Eric Brooks, Wolfe stated that far from being "the naysayers, as we were accused after critiquing the Google-EarthLink deal, we’re actually the truthsayers."

The foursome, who are supporters and providers of current wi-fi services in San Francisco, said although wi-fi rocks when you’re at an outdoor café or checking bus schedules with a cell phone, fiber rules when you’re in a basement, on a fourth floor, or in need of reliable and efficient service or massive capacity.

"That’s why it makes more sense to roll out a joint fiber-cable-wi-fi system, because all the interference and bog downs would be solved by hooking antennas into fiber," Pozar says. "Putting a bunch of antennas up as a cloud over the city supposedly gives free users speeds of 300 kbps, but anyone making a phone call or downloading a video will drain everyone else’s speeds, and blanketing the city with transmitters will make the spectrum unusable by others."

Muehlen expects the wi-fi service his business provides to get "blown out of the ether, technically, or be severely compromised," by the proposed Google-EarthLink deal. "But I wouldn’t mind if I got a network that didn’t suck," he says. "I just want something that works."

Brooks said many people who can’t afford the Internet are "compartmentalized in lower-income areas. Why not begin by addressing those areas instead of giving away the whole 49 square miles to Google-EarthLink?"

He noted that it will cost Google-EarthLink an estimated $300,000 to pay into the city-run Digital Inclusionary Fund. "That’s a drop in the bucket in terms of providing residents with gear, training, and support that truly bridge the digital divide." *

Scarface: The World Is Yours

(Vivendi Universal; Windows XP, PlayStation 2, Xbox, Sony PSP)

GAMER One nice thing about Scarface: The World Is Yours is that although it is a first-person shooter–adventure game, there is no sewer level. It doesn’t matter what the story line is: at some point, dude is going into a sewer and tromping through ankle-deep water with rats skittering around.

Scarface doesn’t bother with that. It’s more interested in having you sell cocaine and brutally murder people, like a good game should do. You peddle so much coke that it’s really astonishing the game hasn’t offended nutty Christian groups. Maybe the makers were able to get around objections because your character, Cuban drug lord and world-class cusser Tony Montana, never kills innocent people. If you point your gun at a civilian, you find yourself saying, "Not in my game plan, bro," or the best one, "I kill one and I go straight to hell." In each case, the gun will not fire.

The game is still unspeakably violent. The story picks up right before the part in the movie Scarface when Ángel Salazar’s killer sneaks up behind Montana and airs him out. Instead of this happening, however, you direct Montana through an epic bloodbath in order to survive, so he can regain his spot at the top. Along the way, Grand Theft Auto: San Andreas’s formula is perfected, the makers take character interaction to a new level, and you end up playing a game that could go on forever.

The scope and game play are very much like those of GTA: San Andreas, but everything’s been streamlined. Montana doesn’t have to fucking work out, eat, and shit, and there is no repetitive dating scheme. Instead, you just sell coke and kill, drive around really fast, spend millions of dollars on useless items, and pick up women.

Interacting with the peripheral people is really fun too. Montana has some standard dialogue, but once in a while an actual unique conversation will occur. When talking to pretty women, he says predictable things, but when he pulls similar pickup moves on elderly women (who give "are you nuts?"–type responses), it’s really funny. He orders his lackeys around like Don Rickles on an f-bomb rampage. When he steals a car, he utters any number of one-liners, from "Um, this is Miami undercover police — I need your car" to "You can keep the puta — I just want the car." And on top of being hilarious, the character is almost perfectly voiced by a guy named Andre Sogliuzzo, reportedly handpicked by Al Pacino for the job. James Woods, Elliot Gould, and many other actors appear.

You have the option to play as three characters other than Montana: the driver, the enforcer, and the assassin. You steal cars, bust heads, or eliminate government officials for big paydays. These missions are inexhaustible. So are Tony’s drug dealing and delivery missions, all of which are chosen from a menu. It’s nuts. This means you are free to select what to do and when you want to do it, but more important, it means there is no real end to the game ever. Even after the extensive story line is completed, there are an endless number of rival gangs for you to tangle with. Once you have defeated all the big bad guys, you sell coke and collect money. It’s like a locked groove.

Sometimes these movie-themed games are really crappy rush jobs. But it is obvious from the very start that the folks behind Scarface not only love the movie — an important factor — but also were interested in making what is potentially the best game of the past year. (Mike McGuirk)

Stand in the place where you live

I guess I’m a snob. It’s not easy to admit, since I like to fancy myself a salt of the earth type, but there it is. I’d just assumed that after making two albums for Fat Possum, 2005’s Stairs and Elevators and last year’s amazing All This Time; opening shows for the Drive-By Truckers and Lucinda Williams; and touring clubs relentlessly in the headlining spot, the next logical step for Cincinnati’s Heartless Bastards would be a change of geography.

I’ve never been to Cincinnati. My only experience with Ohio — besides the Neil Young song — was driving through the opposite end of the state on the I-80. What’s "hi" in the middle and round on both ends? Not Ohio — seemed to me it was flat all the way across. And humid. But what do I know? The only time I stopped was to gas up and indulge in an ill-advised all-you-can-eat steak (i.e., sinew and cartilage) special at a Truckstops of America. What I am familiar with is the great rock ‘n’ roll migration tale, featuring groups such as the Dead Boys moving from Cleveland to New York, which probably had more to do with the ready availability of smack than it did with making it. The West Coast version plays itself out as a southerly flight to the home of clapped-out hair bands and cheap tacos: Los Angeles. Even our beloved Melvins, who wended their way down from Aberdeen, Wash., and lodged in San Francisco for a magic period, ended up there, chasing the dragon of rock success.

So it’s ironic that after years of thinking it was lame when bands left the Bay for a chance at the big time I’d ask Erika Wennerstrom — the vocalist, guitarist, and principle songwriter for the Heartless Bastards — if the trio were thinking of moving away from their place in the heartland. I’ve bought into the stereotype that the edges are where it happens and that the center — with the exception of Chi-town — is a cultural vacuum.

"No, not really," Wennerstrom says over the phone. "I like Ohio." If I didn’t know where she was from — Dayton, originally — I’d be baffled by her accent. There’s a lilt, a slight twang, and a flatness to it, all at once — high in the middle and round on both ends, a hominess that’s entirely absent in her soulful, from-the-gut singing voice. Isn’t it just like a snobby SF bastard to find it quaint?

"I just think if we tour enough," she continues, "we’re eventually going through enough cities anyway. Plus, sometimes you end up being part of the whole rat race. I hate to use that word," she adds hastily. "There’s lots of big cities I enjoy, but I don’t know if it’s worth having to juggle three jobs."

They may not be juggling, but the HB’s are no strangers to work: drummer Kevin Vaughn works at an incense factory in nearby Oxford, while bassist Mike Lamping works for his family business, Superior Janitor Supply, which receives a shout-out in the "Very Special Thanks" section of the new album. After the last trip around the country in a van, Wennerstrom finally felt that she’d made enough to cut back on bartending and focus on songwriting.

And maybe that’s where my whole "why don’t you move" thing comes from. Listen to Wennerstrom’s dreamy ooh-wooh-hoos over the violin and viola on "I Swallowed a Dragonfly" — "in hopes that it would help me fly" — and you’ll hear a magic that transcends punching clocks and pulling beers. All This Time is so good, it gives me this "go tell it on the mountain" feeling, which, in turn, leads to a mild bitterness: Why aren’t the Heartless Bastards famous yet? Why are they opening for Lucinda Williams, great as she is, at the Fillmore and not headlining the Fillmore? How can they win Best Rock Group and Best Album of the Year two years in a row at the Cincinnati Entertainment Awards and still be featured in Tom Moon’s "The ‘Overlooked 11’ of 2006" on NPR? Moon has the right idea, and I know I put them on my top 10 list, so who dropped the fucking ball here? And so, somewhat subliminally, my mind starts thinking that maybe it’s Ohio that’s holding them back.

But would they be as good, would the songs sound as sweetly powerful, if there was nothing quotidian to transcend? If they were ensconced in a Hollywood bubble of yes-men attesting to the brilliance of every note? I mean, Jesus, someone in Los Angeles convinced A Simple Plan that they don’t suck. Band members could get lazy if they didn’t have to make an honest living, though I’d have to add that’s what’s so damned appealing about the Heartless Bastards: there’s something honest and unassuming, something unpremeditated about their songs. Despite their name, their music clearly comes from the heart. More precisely, it comes from the hearts of working-class Ohio musicians who haven’t been feted by the same painfully out-of-touch A&R assholes who learned nothing from Nirvana’s momentary pimp-slap of the artistically bankrupt LA record industry: you can’t fabricate honesty.

"I really don’t need a lot," Wennerstrom sings on "Blue Day." "Just trying to hold on to what I got." *

Make housing, not war!

OPINION As President George W. Bush requests more money to fight the war overseas, a stealth war is being fought here on domestic soil: the war on housing for the poor. Since the Bush administration took power, the public housing program has suffered $1 billion in cutbacks.

As a result, conditions have rapidly deteriorated in public housing developments throughout the country. Maintenance, security, and services have been slashed annually as budgets are drained with each appropriations bill. A climate of violence, fear, and despair has taken hold in the projects, where years of deferred maintenance, toxic and unsanitary conditions, and government neglect are simmering to a boiling point.

As we fought terror abroad, the Republican-led Congress created a breeding ground for terror here at home. Just ask the desperate, homeless families who refuse offers to move to the city’s public housing developments for fear of their lives. Or ask the mothers of children who have been shot at in their front yards while attempting to escape the leaking sewage and toxic mold in their homes.

Yet rather than fight this terror in our own backyards, lawmakers have attacked the very programs that can provide a solution. Job training, education programs, and social services have all been casualties of the war on public housing. Agencies have been forced to make cuts in security and maintenance staff every year. In the past five years alone, the San Francisco Housing Authority has lost 250 employees, a 50 percent cut.

While military spending has continued to rise, the offensive against housing has also escalated. A full $600 million was cut from the 2006 public housing budget, funding housing authorities at only 85 percent of overall need. Layoffs and cutbacks occurred throughout the country as cities began planning for desperate measures such as disposing of properties, raising tenant fees, and increasing response time for repairs. In San Francisco, 26 housing authority staff lost their union jobs last year. As a result, vulnerable senior and disabled residents in high-crime neighborhoods saw their security services eliminated.

Last year was devastating for public housing residents, and the battle is far from over. The generals of the war on housing are out for blood, and it appears that they will not stop until the last vestiges of federally funded, low-income housing are destroyed. This was made abundantly clear recently when the Department of Housing and Urban Development announced that in 2007 housing authorities will be funded at only 76 percent of the actual need. By proposing a budget that is $1 billion short, President Bush has raised the stakes in the fight to preserve our precious remaining federal housing for the poor.

Congress has a chance to increase funding when it passes a spending bill next month. Without an increase, San Francisco will face a $3.5 million shortfall. Our powerful new leadership must take a stand against these unconscionable cuts, which could starve local housing agencies to death.

The only way to avoid increased homelessness; displacement of poor families; loss of union jobs; heightened violence; and turn-of-the-century, tenementlike living conditions for San Francisco’s poorest residents is for our representatives to insist on an increase in funding. The governor’s wimpy health plan

EDITORIAL The good news — and it’s very good news indeed — is that the governor of California has followed the lead of the city of San Francisco and is talking seriously about a universal health care plan. This is the first time since the early days of the Clinton administration — before the insurance companies destroyed even a modest hope of national reform — that we can sense real momentum toward the creation of a new policy to address one of the most pressing issues in the country.

But let’s be clear: the governor’s proposal falls far short of real reform. It has a few attractive features, but overall it’s underfunded, at points dysfunctional — and ducks the most basic problems with the state’s health insurance system.

Like Bill Clinton, Arnold Schwarzenegger starts with a failed premise — that private insurance, linked to employment, can somehow solve the problem. The evidence against that is so clear it’s frustrating even to have to make the argument. Private health insurance is expensive and inefficient; the amount of money that’s wasted on overhead and profits is staggering (as much as 30 cents out of every health care dollar never makes it to any hospital or clinic). The incentive to bilk consumers, avoid covering the sickest of patients, and reward suffering is disgracefully high. The fact that the United States is the only Western industrialized country without a functioning national health care program is a direct result of the fact that private insurers run the show.

Employer-based health insurance is a failed system too, an amalgam that grew out of the federal government’s failure to recognize the need for a national health system in the postwar era and the demands of unionized workers for better benefits. Workplaces offer insurance companies what they want — large pools of people among whom to share the risk. But linking insurance to employment is obviously a bad idea at a time when more and more people are working part-time jobs, contract jobs, or a series of different jobs for different companies — and when small businesses (which create most of the jobs in the country) are getting hammered by double-digit annual increases in health insurance premiums.

So any plan that accepts the private-sector hegemony over health insurance is doomed to fail in the long term.

The Schwarzenegger plan has another dangerous component: the proposal would require everyone in the state to buy health insurance (at the risk of criminal penalties for noncompliance). That, of course, is an insurance industry dream — it makes the entire population a captive customer base. And while the governor promises to offer lower-cost plans and subsidies for the poor, there’s nowhere near enough money in his proposal to make private insurance affordable to all. Low-income people would be driven to buy high-deductible plans, which undermine the entire idea of universal health care. And middle-class people who don’t have employer-based plans may be devastated: in San Francisco, for example, a family of four living on $60,000 a year would have to put as much as $10,000 of that into health insurance or risk steep fines.

The overall financing is shaky — the governor is counting on federal funding to help put an additional 630,000 people on the Medi-Cal rolls, but Congress has a long list of spending priorities, and there’s no guarantee this one will make the final cut.

There are things to like about the plan, particularly the goal of covering all children in the state, including the kids of undocumented immigrants. And the very fact that the ambitious governor of the nation’s largest state is willing to stake so much on health care reform is encouraging.

But the legislature is under no obligation to start the discussion with the governor’s plan. There’s already an excellent bill out there: SB 840, by Sen. Sheila Kuehl (D–Santa Monica). Her suggestion: get the insurance industry out of the game altogether and create a statewide fund, with premiums paid by employers and individuals, that would cover all Californians. It would save businesses in the state a fortune (and thus give the economy a jolt), cut down on waste and fraud, allow people to move from job to job without fear of losing health care, and give the government a strong incentive to push for lower drug costs.

That’s where the debate ought to begin. *

Careers and Ed: Hard on the job

Just a short walk northeast from the Hall of Justice in SoMa lies an internationally renowned palace of forbidden pleasure.

The nondescript four-story stone building is the headquarters for Kink, an online enterprise specializing in the production of short, sexy, streaming BDSM videos, available for a monthly subscription fee. Started by British bondage aficionado Peter Ackworth about a decade ago, Kink is home to such fetish favorites as Hogtied, Fucking Machines, and Ultimate Surrender (in which the winner of a female wrestling competition in a Greco-Roman setting gets to fuck the loser). It’s also — perhaps surprisingly — a great place to work, according to the people who work there. And that’s not just those strapped down in front of the cameras talking.

Granted, when you were young and dreaming of a fabulous career in film, porn might not have been your chosen niche. But if you’re looking for a job in media and are unenthused by the paltry postings on Craigslist offering the opportunity to work in the lackluster world of industrial video production, you might want to broaden your options. There used to be a steadier stream of work shooting commercials and Hollywood films on location here, but the high costs have caused that flow to taper off. Still, the Bay Area harbors a vibrant industry creating DVD and Internet adult content.

Crack all the jokes you want about the sleaziness of the porn business, but there’s some real dedication behind it. I used to have a job where I regularly interviewed people about their jobs: dot-com jobs, to be specific. Most of the time, the Web guru, marketing guru, or whatever guru I was interrogating would stare at me with a Stepford wife’s eyes and tell me what a blast it was to work at blobbity-blah.com. All the while I could hear the voice in his or her head blaring, "If my stock options end up amounting to nothing more than toilet paper, I’m gonna be pissed!"

Many local erotica production studios, on the other hand, offer a positive and creative work environment, upward mobility, and good pay with full benefits for everyone from customer service representatives to IT workers and video editors.

ONE HECK OF A DAY JOB


As I’m guided through the maze of sets at Kink — a jail cell, a dirty bathroom, a dungeon with vaulted ceilings reminiscent of the Doom video game, even a sci-fi room — I pass workers who are going about the business of making naughty fantasies come to life. Production assistants in black jumpsuits prepare sets for shoots. Set builders in flannels construct a booth in the back lot for the imminent Adult Video News Awards in Las Vegas. A model naps in the green room before his close-up.

In the office space where the postproduction editors work with the directors to piece together videos on large, brilliant flat-panel monitors, everyone I see looks like someone who could be working at an indie rock record label. They’re hip, young, hard at work, and having a good time.

I get to interview some of them on the canopied roof deck, replete with a bar, heat lamps, and a hot tub. Kelly Schaefer, a young woman with jagged layers of blond locks jutting to her chin, tells me she’s worked at Kink for about a year. Now the lead production assistant, in charge of scheduling and training all the other PAs for shoots and making sure everything runs smoothly, she started out as a model, performing in Kink’s Ultimate Surrender. The former Good Vibrations sales associate still models, because she really enjoys the wrestling. But she’s also working toward becoming a full-fledged producer.

Schaefer has a rep around Kink for being motivated, which is partly why she was able to move into a different role with greater responsibility. Since she didn’t have a background in production, being a model helped her get a foot in the door. For those interested, Schaefer says, "It’s a great company if you’re just getting started in BDSM." Kink follows the BDSM credo of safe, consensual, and respectful play and trains its PAs to make sure that all models are treated well, taking care to stop the shoot when limbs fall asleep during difficult poses involving mouth gags and rope.

Her coworker Guillermo Garcia, a videographer and PA, got his start by taking a number of production and editing classes in Final Cut Pro at City College. In addition to gaining more experience in lighting a soundstage on the job, the dreadlocked musician from Medellín, Colombia, says he enjoyed scoring the theme to Ultimate Surrender. He also has to make sure all the gadgets for the Fucking Machines series are in proper working order and, truth be told, clean the sex toys.

PERKS AND PACKAGES


Over at Colt Studios, which is in a converted warehouse near Potrero Hill that also houses an accounting firm, a team of 19 people works hard to produce slick and beautiful photos, calendars, and videos of handsome, masculine guys.

President John Rutherford, who got his degree in broadcasting at San Francisco State, realized that making internal videos at Hewlett-Packard with straight guys wasn’t in his future. He started working at San Francisco’s famed hardcore gay porn company Falcon Studios just as he was coming out. Rutherford said he aims to run a team of creative and self-directed people who are serious about attaining company goals. He likens working with porn to a nurse working with blood. "I can’t even watch Nip/Tuck, but here I think, ‘Hey, that’s a great picture; that’s a big dick.’ " It’s all in a day’s work.

His business partner, Tom Settle, says, "Our customer service agents get the question at least once a day: ‘Well, what’s it like to work there?’ People have a fantasy that models walk around servicing our customer service agents all day…. We’ve had people come to work here looking for the forbidden fruit. When they find out it’s not what they expect, they think, ‘Well, I could never tell anyone I work here.’ "

Not that it’s dull working at Colt, a company with a 40-year history of male erotica production, mind you. The elegant offices are filled with fine art. Georgia, Rutherford’s beagle, roams freely. The staff is urbane and witty.

Kim Ionesco, a Colt customer service rep who is starting to work more in marketing, jokes that she never thought her career would flourish in male porn. "I didn’t hit the glass ceiling," she exclaims, sipping a Red Bull. When she started working at Colt, all her lesbian friends began clamoring for DVDs starring Chris Wide, a hot property in Colt’s exclusive stable. She had no idea her girlfriends would know who he was. Then again, she quips, "I appreciate nice, polite, good-looking gay men." So why wouldn’t other dykes feel the same way?

Even straight IT professionals such as Aaron Golub find working in male, mostly gay porn surprisingly refreshing too. Previously, he worked as an IT director at a multinational company but quit because, as he explains, "I did not feel like what I was doing was noble. I feel more guilty about generating junk mail. I’ve never sat there and said, ‘Oh, I need some advertising,’ but I’ve definitely felt like I needed porn. I feel like what we’re doing is for people who really, truly want it. Where I worked before, I didn’t feel like that was truly the case."

Aside from working toward the common goal of providing customers with images of Colt’s much-admired, wood-chopping manly men, the twentysomething IT whiz gets to work with technology on the cutting edge. "We’re doing things you don’t do when you’re developing a site for IBM." He wouldn’t tip his hand, but basically he means that by making downloads and streams seamless and infallible, online porn is on the forefront of content delivery.

When I ask him if working in porn might cause some stigmatization with future employers, he says, "I’m in a different boat than actors or directors, because my skills are very transportable. I’m not in a situation where I’m going to have to present a reel." He also echoes what every other worker I interviewed told me.

"I wouldn’t want to work for someone who has a problem with what I do." *

Nurturing the drive

Sheri Wetherby was working at a casino in Tahoe when she decided to become a computer programmer. So she left Tahoe and came to the Bay Area to study. A few years later, she had a job at Microsoft.

Wetherby had hardly a lick of programming background before she got her MA in computer science at Mills College. Her undergraduate degree was in German and French. She’d taken some graduate courses at the University of New Hampshire, including a computer science course that inspired her to envision a second career in the field. But how, she wondered, could she find a program that would allow her to master computers, coming from a liberal arts background?

A friend told her about New Horizons, a reentry program at Mills that teaches computer programming to students with nontechnical backgrounds. "I found the small classes and individual attention helped me get a grounding" in computer science, she says, "before moving on to more advanced topics."

The New Horizons program is specially designed for grad students who don’t have an undergraduate degree in computer science. It consists of two undergraduate-level computer science classes per semester for students who also hold down jobs and family responsibilities. Students can choose to finish the New Horizons program with a certificate but most go on to pursue a master’s degree from the Interdisciplinary Computer Science program at Mills. The ICS program aims to build bridges between computer science and computer users and offers graduate coursework as well as a master’s thesis track.

Some New Horizons students find computer science too difficult or different than they expected, "but the majority are successful and happy," Mills computer science associate professor Ellen Spertus says. She recommends students with no CS experience try taking some community college courses in the subject first — to see if their eyes are bigger than their stomachs, in programming terms.

At a community college, students can take the prerequisite math and CS classes at a fraction of the cost before going to Mills, says Constance Conner, an instructor in the Computer Science Department at City College of San Francisco who studied in the ICS program at Mills. Community college "is also a good place to start if a student is not 100 percent sure" about a CS degree, she says. Then, if students’ appetites are still whet, the Mills program will guide them along a new career path.

CRISIS OF CONFIDENCE


Computer science is seen by many hopefuls as a lucrative but daunting field. In the public’s mind successful programmers are young, mostly male wizards who almost cosmically penetrate thickets of computer languages and database engineering to manifest unfathomable products. Spertus finds that many students going into her program suffer from low self-esteem — especially female students. She says they’ll be earning A’s in the program’s classes but will be convinced they’re not doing well and somehow "don’t belong." Her teaching style, simultaneously rigorous and nurturing, helps change their opinion, she hopes.

Introductory CS classes at most universities "act like weeder courses," scaring away all but the most confident students, Spertus says. Typically, up to half the students fail or drop out of introductory CS classes at other institutions. Spertus says this phenomenon hits women hardest because they may have less computer experience as well as less confidence.

Also, some students apologize for not having undergrad degrees in CS. Spertus always tells them computer scientists with a narrow focus are "a dime a dozen." But people like them, who know CS along with another field, are unique.

RIGHTING THE BALANCE


Erica Rios has been an activist since she was a teenager but became frustrated that activists were still using the same methods of organizing Martin Luther King Jr. employed back in the ’60s. She had a political science degree and a minor in Chicano studies from UC Davis. As a labor activist for small community nonprofits, she had to teach herself to use computers because nobody else knew how. She saw how technology was changing her native San Jose. She wanted to learn "how tech could be used to engage people in the issues that impact them but they don’t necessarily have a direct voice on."

Though Mills is a women’s undergrad college, it accepts male graduate students. Men typically make up roughly a third of the participants in the ICS program, but the majority-female environment creates a unique classroom culture. The different gender balance was helpful to Rios because she had a nine-month-old child when she started the program. She felt more comfortable bringing her daughter to her Java class than she would have in a male-dominated classroom — and less apt to fall behind on coursework.

The few men enrolled during Rios’s time brought a balance to the learning environment, she believes, while showing her that she need not feel uncomfortable as a woman in the computer science field. "There were two other men in class with me and about seven going through the whole program," says Barton Friedland, one of the men who just completed the ICS program. For him, it felt very different to study "with a preponderance of women, but that’s something you can learn from."

Friedland took some classes at Stanford before going to Mills. "There seemed to be this attitude where if you asked questions in class, people looked at you funny." If students admitted they didn’t know something, they would lose status, and they were supposed to figure out things on your own. Despite Stanford’s reputation as one of the top schools in the country, Friedland found Mills’s curriculum more thorough.

The smaller class sizes at Mills were also helpful, Rios says. At UC Davis the average class size is 300 in lower-level courses and 75 to 100 in upper-level classes; a class size of 12 to 15 students is more conducive to learning, she found.

It "felt like everyone belonged there and [was] equally capable of learning. I didn’t always feel that in larger classes."

The Mills professors "don’t throw too much jargon at you, making you feel like you’re not smart enough," Rios adds. Instead, the professors step back to observe how students approach problems, then help them learn to problem solve from a more hard-science perspective. Rios now works as an Internet project manager at the Anita Borg Institute for Women and Technology, using her activism background to "explore ways in which we can use technology to advance women."

"I felt comfortable speaking in class and asking questions, where in a typical classroom I would not," says former ICS student Lisa Cowan, who has a BA in anthropology and is now pursuing a computer science PhD at UC San Diego. "The professors taught class in a highly interactive way, asking questions and encouraging discussion, helping us solve problems together, making sure all students thoroughly understood the material being covered."

PAVING THE WAY


The ICS program at Mills isn’t the first reentry program of its kind in the Bay Area. UC Berkeley opened a program in 1983 as a pathway to graduate study in computer science for women and minority students who were underrepresented in Berkeley’s crowded and competitive program. Two female Berkeley graduates, Paula Hawthorn and Barbara Simons, noticed in 1982 that the number of female graduate students entering the CS program was actually decreasing over time as the requirements became more geared toward people who had pursued a standard math or engineering track.

The Computer Science Reentry Program at Berkeley gave 159 students a concentrated education in upper-level computer science classes. Ten of those students have gone on to get PhDs. But the program had to fold in 1998 when California passed Proposition 209, which prohibited any state-funded programs that discriminate based on gender and ethnicity.

MULTIPLE PATHS


The interdisciplinary part of the Mills College ICS program’s name means students combine computer science with another area of study to produce their master’s theses. "It gives you a really broad brush," says Wetherby, the former casino worker. When a student comes to Spertus with a thesis idea, she always asks how it uses what the student has learned about computer science. But she also asks why the thesis is something that she, a narrowly trained computer scientist, couldn’t do. She finds the interdisciplinary approach helps students make more of a contribution and also realize they can do things that Spertus, who has a PhD from MIT, can’t.

While still at Mills, Wetherby had internships at IBM and Apple Research. When she was job hunting after the program, someone from Microsoft called her because her studies had combined computer science and education. Microsoft needed someone who could write educational programs to teach programmers about Microsoft tools.

Another Mills student, Liz Quigg, had already been an applications programmer at science labs before joining the ICS program. She’d crunched high-energy physics and moon-walk data. But the program’s interdisciplinary focus also helped her get into writing educational software. Afterward, she was able to help create educational programs for the science center at the Fermi National Accelerator Laboratory in Illinois.

"It was very useful because my job now is very interdisciplinary," Quigg says. "I work with scientists, teachers, and students. I cross different worlds." *

But she also asks why the thesis is something that she, a narrowly trained computer scientist, couldn’t do. She finds the interdisciplinary approach helps students make more of a contribution and also realize they can do things that Spertus, who has a PhD from MIT, can’t.

While still at Mills, Wetherby had internships at IBM and Apple Research. When she was job hunting after the program, someone from Microsoft called her because her studies had combined computer science and education. Microsoft needed someone who could write educational programs to teach programmers about Microsoft tools.

Another Mills student, Liz Quigg, had already been an applications programmer at science labs before joining the ICS program. She’d crunched high-energy physics and moon-walk data. But the program’s interdisciplinary focus also helped her get into writing educational software. Afterward, she was able to help create educational programs for the science center at the Fermi National Accelerator Laboratory in Illinois.

"It was very useful because my job now is very interdisciplinary," Quigg says. "I work with scientists, teachers, and students. I cross different worlds." *

Swanky-ass bars, high-end restaurants, sex, drugs — they’re all great things to love about San Francisco, but they can be cruel and constant symbols of failure to the scrilla deprived. With one-bedroom apartments currently priced at about $1,600 a month, cell phone bills hovering in the $75 to $150 range, and PG&E. religiously raping us for half our salaries, it’s amazing anyone can afford to live in this city, let alone enjoy its vast array of entertainment. But San Francisco has a secret. Unlike most cities, San Francisco pays its waiters, bartenders, and bussers almost $10 an hour. Add to that a healthy tip stash, and there’s at least a little disposable income to hit the town with.

Of all the jobs the service industry has to offer, bartending rules. We’re talking potentially $200 to $500 for six hours of work. OK, count me in. The major problem, though, is acquiring the skills to qualify. San Francisco has almost as many service-industry schools as it does bars and restaurants. Would I get scammed if I enrolled in one? With the ultimate goal of becoming a bartender, I spent a month researching the cultlike world of barkeep education, starting with a quest for the perfect school.

THE SEARCH


In order to minimize any money and time investments, I first looked for Web classes and free tutorials. I should have known better. Looking for a free or relatively inexpensive online course in bartending turned out to be a bigger waste of time than the hours I logged scouring the Internet for free porn as a young man. The sites of my youth always promised girl-on-girl action, fist-fucking, and bizarre fetish acts but only generated advertisements for sketchy online subscriptions or outrageously expensive chat sessions. The same was true, metaphorically, of www.bartendingcollegeonline.com, www.ebartending.com, and www.zizoo.com. Each one taunted me with screen shots and personal testimonies but wouldn’t give up the goods without a credit card number. So I passed on the virtual cocktail-slinging and set about finding a real-world educator.

ABC Nationwide Bartending School (www.abcbartending.com, 1-888-262-5824) looked promising but seemed a little too corporate for my taste. Other schools, such as National Bartenders School (870 Market, suite 828, SF; 415-677-9777, www.nationalbartenders.com), seemed legitimate but didn’t quite have the attitude and style I associate with the glamorous life of a bartender. I want to be Tom Cruise in Cocktail, not the sad barkeep from Billy Joel’s "Piano Man." I want to serve mojitos, cosmos, and lemon drops to drunk yuppies, ending every night with fistfuls of easy cash and invitations to cologne-drenched orgies. Glamour! Eventually, I seemed to find perfection in the San Francisco School of Bartending (760 Market, suite 833, SF; 415-362-1116, www.sfbartending.com), a school run and taught by local SF bartenders — sort of a FUBU for mixologists.

It works like this: for about $300 (a slow night’s tips for the average SF bartender) you get hands-on training and insider information from a seasoned professional. The classroom simulates an average pub, with music, neon beer signs, and a supersize bar with a pouring station for each student. There’s homework every night, a daily quiz, and a final exam. Near the end of every minisemester, students get a consultation with a professional résumé builder who has magical contacts to the city’s premier restaurants and bars. It’s a boot camp for bartenders, taught by some of the toughest and most knowledgeable drill sergeants around. The slick Web site, affordable price, and sense of community won me over. After a few simple clicks I was all signed up for a two-week course ($295, financing available).

ORIENTATION


When I arrived at the SFSOB bright and early on a Monday morning, I was immediately greeted by Gretchen Mitchell, a veteran bartender who has served in more than 50 restaurants and bars in her 19 years in the industry. She wasted no time getting started. "All right class, answer me this: if someone comes up to my bar and tries to get a slow screw up against the wall, what am I going to do?" There were blank stares all around as the other students and I tried to think of the right answer. "Should I give a knowing smile and assume the position?" she said. "Hell no! I don’t think so. A Slow Screw Up Against the Wall is a mixture of sloe gin, vodka, and orange juice with a splash of Galliano. I know this, not because I have it memorized, but because I think like a bartender, and that’s exactly what we’re going to teach you to do over the next two weeks. Now get behind your stations and get ready for some action." She paused, then added, "You’re gonna thank me, guys. In no time at all you’ll be having ‘creamy sex on the beach’ with a whole gang of ‘redheaded sluts.’ And ladies, you’ll be serving up expert ‘blow jobs’ and ‘screaming orgasms.’ " With that, class had begun.

LEARNING TO POUR


I usually wait until around noon to have my first alcoholic beverage, but today was different. It was only 9:30 a.m., and here I was under the soothing neon lights of a real bar. Credence Clearwater Revival played in the background as I wiped down my section of mahogany, filled my ice chest, and got ready to make some drinks. Mitchell passed out laminated cards with pictures of simple drinks like tequila sunrises and screwdrivers and then drew our attention to overhead computer monitors. She was now the patron, and the other students and I were the all-powerful barkeeps. Laid out before us were soda guns, ice scoops, and quick-access mixers. Behind us were countless bottles of fake alcohol, glasses, and towels. We were ready.

"All right, guys, here’s how it’s gonna work: I’m going to walk you through the first couple of drinks, show you how to measure an accurate one-ounce shot without a cup, demonstrate the proper way to hold things, and so on. Then the computer is going to take over for a while. But before I do all that, I want to see what you already know." Mitchell took a breath, looked around, and then said, "Make me a screwdriver right now."

It seemed like an easy request, but as I fumbled around looking for orange juice and vodka, I realized I didn’t know how to mix them correctly. Mitchell watched as we tried to bullshit our way through the exercise. Some scooped ice with their glasses (a major no-no), poured in the orange juice, and then topped the concoction off with a haphazard shot of vodka. Others grabbed the vodka with two hands and then apprehensively poured it into an empty glass before adding the other ingredients. Our new sensei watched in disgust. Soon there were 11 crappy-looking screwdrivers sitting on the bar. The lesson behind the exercise was unmistakable: we didn’t know shit.

We spent the rest of the morning learning proper pouring techniques, standardized orders of mixing, and some light terminology. After lunch we came back and stumbled through a simulated happy hour during which the computer flashed orders while Mitchell marched to and fro shouting suggestions. I thought it would never end. With sweat pouring down my face, fake liquor soaking my shirt, and freezing hands, I poured drink after drink until Mitchell suddenly screamed, "Last call!" The computer stopped flashing. "Good job, guys," she said. "Shift’s over. Now clean up your stations and go home. Remember today’s lesson: bartending is a lot more complicated than you think. It’s not just Bukowski. It’s F. Scott Fitzgerald too."

The rest of the week followed a similar pattern. Mitchell lectured the class on a particular aspect of bartending and then turned the computer on and paced back and forth as we struggled to make drinks. Her teaching style grew warmer over time; eventually, she replaced her cold commands with a soft hand and a helpful voice. Under Mitchell’s guidance mixing drinks became second nature. I could pour a mai tai in a second. Mojitos, cosmos, dirty martinis — I could shoot them all out with ease. By the fifth day I felt like a pro, but I wondered if it was going to work. Would a two-week bartending course be all I needed to get a job? I sought the advice of some experienced bartenders.

THE REAL WORLD


According to Cory Norris, a bartender at an Irish pub in the Mission, the answer is no.

"Man, people come in with those certificates, acting like professionals, but once they get behind the bar, they’re fucking lost. The only way to get good at bartending is to jump in the fire. Those classes only work for people with big tits and blue eyes."

Another bartender, Tommy Basso, owner of Delirium, reiterated Norris’s sentiments. "You can’t learn bartending at a fucking school, kid. You’re gonna get back here and choke. You’re gonna have five dudes mad doggin’ you in the corner ’cause you forgot their beers, two chicks at one end of the bar stealing your cherries, two others chicks distracting you with their tits in the middle, and 20 drinks to make. You’re not gonna know what the fuck to do. Those schools are bullshit."

Basso and Norris scared me. Had my $300 been spent in vain? Had I been duped? In an attempt to assuage my anxiety, I went back to the SFSOB and asked Shawn Refoua, one of the other instructors there, about the real-world difficulties of gaining a foothold behind the bar. Refoua was familiar with the antischool attitude. "There is a scholastic component to every trade." he said. "I mean, can it really be true that bartending is so magical that you can only learn it in the field? That line of thinking just doesn’t make sense." Refoua has been teaching classes at the SFSOB for almost two years and has seen hundreds of students get good jobs. Like most teachers there, he keeps in close contact with his students via the Internet, using his MySpace page to notify them of job openings and changes in the industry. "I wouldn’t worry about people who say bartending schools don’t work," he said. "It’s true that a lot of people either fall into bartending or lie their way in. Maybe that’s why there are so many shitty bartenders around here. Many states actually require certification, you know."

As an SFSOB teacher, Refoua could be a little biased, of course. And real-world bartenders naturally look down on newbies. Any smart-ass could conclude, though, that both have good points. A self-taught bartender knows how to deal with a drunken crowd, and a school-taught applicant comes equipped with a deep understanding of liquor ratios, bar etiquette, and efficient pouring techniques.

I now feel confident enough to submit my résumé to all the places in my SFSOB counselor’s little black book. I can shake, stir, pour, mix, blend, and guess the ingredients in foreign drink names with ease. As far as handling belligerent drunks — well, I’m not worried in the slightest. My friends have taught me well. Just last night I had to stop one of them from jumping out of a fourth-story apartment, slap another in the face for throwing an egg at my girlfriend, and convince yet another to not buy more cocaine at 4 a.m. Bar owners of San Francisco, prepare yourselves. There’s a new cocktail jock in town. *
