Team Newsom’s $$$ value. More or less.

Before we get to the juicy details of how much money Team Newsom is taking home, it’s worth noting that Mayor Gavin Newsom spent last Friday handing out draft copies of the report in which these figures can be found–a report that Budget Analyst Harvey Rose drew up at Sup. Jake McGoldrick’s request to figure out the impacts that staff changes within the Mayor’s Office would have on the City’s budget–changes Newsom announced Jan. 4.

It’s also worth noting that Rose didn’t know that Newsom Chief of Staff Phil Ginsburg was standing around last Friday telling the press that his report was a piece of “bull-.”, until the press called him later that same day and asked him for a comment.

And that all this unauthorized report distribution and undefended “bullshit” calling was happening just five weeks after Newsom announced that the City is facing a $229 million budget deficit and that therefore the city must implement an immediate hiring freeze and across-the-board departmental budget cuts.

Unlike Sups. Chris Daly or Aaron Peskin, who are more typically the targets of the mayor’s famously snippy wrath, Rose isn’t a politician, but a widely respected analyst, and so Team Newsom could hardly accuse him of “political theater”.

Instead, Ginsburg told the Chronicle that, “The budget analyst has no understanding of how salaries work in this city,” while Newsom made the vague claim that, “It’s personal.”

But however much they tried to put a negative spin on Rose report, Team Newsom could not deny that it paints an unflattering picture of the Mayor’s Office as a place that is using over $1 million from other departmental budgets to make new hires and increase the salaries of staff that are assigned to the Mayor.

As Rose reports “The Mayor’s practice of including positions assigned to the Mayor’s Office, but funded in the budgets of the Municipal Transportation Agency, the Human Services Agency and the Planning Department Budgets, understates the Mayor’s Office’s budgeted and actual costs for such positions, while such costs are overstated in those three other Departmental budgets.”

Rose’s report found that

a) The estimated total increased annual salary and fringe benefits costs of the 17 newly-appointed department directors to replace existing directors, and the ten Mayor’s Office staff appointments, two of which are completely new functions, are $553,716.

b) Other City departments fund about $1.34 million in annual salary and fringe benefits for ten positions assigned to the Mayor’s Office, including the mayor’s new climate change director Wade Crowfoot and new Homelessness Policy Director Dariush Kayhan.

c) The costs of appointing Ed Harrington, as General Manager of the SF Public Utilities Commission, Ben Rosenfield as Controller, Mirian Saez, as Interim Director of the San Francisco Housing Authority, and Jordanna Thigpen, as Acting Director of the Taxi Commission have yet to be announced.

d) Terminating Susan Leal, General Manager of the SF PUC, without cause, as is Newsom’s stated intention, will add a further $401,392 to City costs.

e) the mayor’s Office is also recruiting for a replacement to the CityBuild Director, at a cost of $144,596.

In face of these dicey accounting practices, Rose suggests that the Board of Supervisors rescind funding for positions assigned to the Mayor’s Office but included in other departments’ budgets, and the cost of these positions, estimated to be $898, 718, could then come from the Mayor’s General Fund monies.

The Board, says Rose, could also eliminate MTA funding for Mayor’s Office positions which do not directly benefit the MTA’s core functions. Those positions could then be funded, Rose reports, to the tune of $240,943, from the Mayor’s Office’s General Fund monies.

Rose’s report also notes that, “The newly appointed Climate Protective Initiatives Director is a new function unrelated to the MTA’s Safety and Training Unit,” even though the position if currently being funded through monies set aside for that unit.

In the category of coolest stuff in the world, Sasha Wizansky recently sent a copy of Meatpaper (subtitled Your Journal of Meat Culture), a magazine she coedits with Amy Standen, to the Guardian offices. The magazine is a veritable cornucopia, nay, a butcher shop of fascinating articles, from an interview with meat inspectors to found meat photography and a beef heart recipe. I immediately contacted Ms. Wizansky and proposed marriage. What I got in lieu of matrimony was an interview, excerpted below.

SFBG Why did you want to do a magazine about meat?

SASHA WIZANSKY The answer that we usually give for that is we perceived that there is a meat movement going on. We call it the fleischgeist, which stands for "the meat zeitgeist." This was a cross-country trend, which apparently is global as well. People are thinking about meat in new ways. That’s partially in the context of restaurants and home cooking, but also in art and culture. So we started a magazine to report on the fleischgeist and basically collect multiple perspectives on what’s going on and publish them side by side.

SFBG Are you going to include non-meat-eating perspectives?

SW Yeah, that’s actually a huge part of what we do. My coeditor and I believe that people’s choice to not eat meat is actually a big part of the story of meat. That’s something that we’re actually extremely interested in covering. We like to cover all perspectives.

SFBG Do you think there’s been a backlash against vegetarianism and veganism in San Francisco?

SW I personally have witnessed a pretty big shift in maybe the last eight years or so. I moved to San Francisco in ’95 and I felt like most of my friends were vegetarians, and that’s not true anymore. So if my community is representative at all, I think things really have changed. I think part of it is that a lot of the reasons that people were choosing vegetarianism had to do with, you know, organic food and environmental reasons, but now a lot of those same issues are being addressed by meat production. It’s possible now to participate in a sustainable meat economy in a way that wasn’t before.

SFBG Were you ever a vegetarian?

SW I was a vegetarian for seven years. From 13 to age 20. My personal reasons I think had a lot to do with health. Sort of personal choice. There was a moment at age 20 when I decided that it was the right thing for me, healthfully, to eat meat again. And I haven’t gone back.

SFBG What is the most adventurous meat eating experience you’ve had?

SW Well, what I think is really interesting about adventurous meat eating is it’s so much to do with your head and so little to do with your palate. I think the idea of some of these extreme meats is frightening to a lot of people, but the reality is not. I suppose in terms of an extreme meat idea, Amy and I had duck fries at Incanto Restaurant.

SFBG Duck what?

SW Duck fries. Which is a euphemism for testicles. Chris Cosentino, who wrote the recipe for beef heart for [Meat Paper] — that’s his restaurant. The idea of [duck fries] is so extreme; the reality is very mild. They looked like big kidney beans, and they tasted like little sausages.

SFBG As someone who eats meat, do you feel there are moral ramifications and karmic and moral weight to eating meat?

SW This is a tough one. I’m not sure I want to go all the way there about my own choices. But I think it’s complicated. On one level it feels like an uncomfortable thing that an animal should have to die for me to eat. On the other hand, I see myself in a lineage of a species that has existed, you know, forever, eating meat. These are contradictory things, and sometimes it’s a moral tug-of-war. It’s something that I think about a lot. People assume that because I edit a magazine about meat that I’m eating bacon and sausages [all the time]. Actually, I am going to a salami tasting tonight. But I don’t eat meat three meals a day.

From Juliet to Mother Teresa and Mrs. Bates

Born in Argentina and raised in England, Olivia Hussey was just 15 when she was chosen to play li’l miss Capulet in the 1968 version of Romeo and Juliet. Since then she’s had a bewilderingly diverse career that encompasses work with Burt Lancaster ("a lovely gentleman"), Vanessa Redgrave ("such a giving lady"), and Michael Jackson (Hussey acted in an unreleased Jackson music video that also featured Lou Ferrigno), as well as legendary softcore directors Radley Metzger and Zalman King. Hussey has played the Virgin Mary, Mother Teresa, and Norman Bates’s mom. She’s done voice work on Pinky and the Brain and Nintendo games. She appeared in the infamous 1973 musical version of Lost Horizon and starred in the 1974 mother of all slasher flicks, Black Christmas. She’s been in adaptations of Sir Walter Scott, Stephen King, and Harold Robbins. Her résumé also includes Turkey Shoot (a.k.a. Escape 2000), a particularly nasty and effective 1980 Australian spin on "The Most Dangerous Game."

In addition to acting gigs, the still gorgeous 56-year-old Hussey remains busy with her clothing line of romantic kaftans and tunics, which are quite beautiful. She’s also a sales rep for mangosteen beverage ZanGo (the health benefits of which had not yet been determined as of deadline by yours truly). She recently spoke with me by phone from her Los Angeles home. The interview had been delayed by a home emergency.

OLIVIA HUSSEY I really have to apologize for missing your call earlier.

SFBG No problem, but as punishment my questions will now be limited to Lost Horizon and Turkey Shoot.

OH Oh god! But people do ask me about Turkey Shoot. I laugh about it as one of the worst movies ever made. Yet a friend of mine in Rome loves it — he hosts regular screenings.

SFBG I actually heard your Romeo and Juliet before seeing it. A junior high English teacher played the soundtrack to our class, which laughed uncontrollably because there’s so much panting. Of course, it made sense in context later on.

OH Oh yes. Franco [Zeffirelli] really pushed us for what he called "that breathlessness of youth." He was obsessed with it.

SFBG Speaking of which, your breasts were so pushed-up — you must have been extremely tightly corseted.

OH I was! A lot of the clothes were very imperial style, [with] high-breasted velvet. But to get them even more so I had interior corsets pulled tight — it was really hard to breathe. Sometimes they had to take breaks between shots simply because the costumes drenched me with sweat.

SFBG Your Romeo, Leonard Whiting — are you still in touch?

OH We’re still close; I just spoke to him last week. Most actors do maybe a hundred films, and they’re lucky if they do one real classic that’s remembered. Romeo and Juliet is still shown to students everywhere. I get e-mails from young people all over the world. It’s such an honor.

SFBG What was it like working with Zeffirelli on both Romeo and Juliet and Jesus of Nazareth?

OH He’s the best. In a perfect world I would have worked with him only, forever. People always ask if I had a crush on Romeo, but I had a crush on Franco! The man had so much passion for what he did.

SFBG Your career slowed down for a few years immediately afterward.

OH I was offered all kinds of things. But when I was the hottest young actress in the world, I didn’t feel like acting. I’m that kind of person.

SFBG You got very busy later on, though. What are some of your other personal favorite movies or roles?

OH I loved doing a 1974 low-budget film in Canada with a new director, Bob Clark — Black Christmas. We had a blast. Much later I auditioned for the Steve Martin film Roxanne, and he stuck around just to meet me. He said, "You starred in one of my favorite films of all time." I said, "Oh, Romeo and Juliet?" But it was Black Christmas. He’d seen it 10 or 12 times.

SFBG Any particularly unpleasant experiences?

OH I didn’t like doing [the all-star 1978 Agatha Christie mystery] Death on the Nile. I had agoraphobia at the time, and that was really hard. On the other hand, Peter Ustinov was so much fun, Angela Lansbury an absolute delight, and David Niven lovely. We were all so excited to meet Bette Davis — she was such a legend. But it’s awful to work with someone who’s just unpleasant.

Also, three weeks into rehearsals for Lost Horizon, I knew it was going to be bad. [Costume designer] Jean Louis kept asking me, "Are you eating too much?" and letting out my waistlines. I was afraid to tell the studio I was pregnant.

It’s about quarter past seven on a Thursday night, and I’m late for curfew. Not even during my wildest high school days did I have to be home by a certain time, but tonight, 29 years old and sleeping in a homeless shelter, I’m supposed to be in by 6:30 p.m.

Heading down Fifth Street toward the shelter, I wonder what I’ll do if I lose my bed for being late. Can they set me up at a different shelter? Will I have to head back to a resource center in the Tenderloin or the Mission District to wait in line for a reservation somewhere else? Either way, I could be walking the streets for the next few hours, so I adjust my heavy backpack for the journey. Waiting to cross Bryant Street, I stare up at the large, hulking building with its utilitarian name, Multi-Service Center South, and notice there are no shades on the windows in the men’s dorm. Since it’s lit from within, I can clearly see someone standing beside his cot, clad in nothing but blue plaid boxers, obviously unaware that he’s so exposed. I wonder if the windows would be shaded if it were the women’s room. Maybe that’s why we sleep in the basement.

Inside the door I shed my pack and step through the metal detector. The security guard dutifully pats it down and pushes it back into my arms. At the desk I give the last four digits of my Social Security number and am checked in. No questions about being tardy. I’m in.

I’m also late for dinner. A staffer hands me two unwrapped sandwiches from a reused bread bag under the counter. Ham, mustard, and American cheese between two pieces of cheap, sliced bread. After two days in the shelter I still haven’t seen a piece of fruit or a vegetable. I wrap the sandwiches in the newspaper under my arm and head down to my bunk. On the stairs I pass a guy and nod hello. He nods back, then calls out, "Hey, can I ask you something?"

I turn. "Sure."

"What’s a nice girl like you doing in here?"

I shrug and step back, unsure of what to say.

"I’m not trying to mess with you," he says. "I’m not fucking with you. I don’t do drugs. I’m straight. I don’t mess with anything," he goes on, trying to reassure me.

I believe him and dish it back. "Then what’s a nice guy like you doing in here?"

He laughs and shrugs. He tells me he doesn’t really stay here. It’s just for a couple of days. He lives in a $200 per week hotel in Oakland, but if he stays there more than 28 consecutive days, it becomes residential and the rates go up, so he clears out for a few days every month and comes here. The hotel’s nicer than this, he claims. It’s clean and safe, and he has his own space. "I can walk around in my underwear," he says.

We sit on the stairs, talking about how you lose all your privacy when you stay in a shelter, how the regimentation is reminiscent of prison. There are no places to go and be on your own, rest, and be quiet. Once you’re in for the night, you can’t leave except to step out for a smoke.

I ask if he has a job. He tells me he’s a chef for Google. I raise an eyebrow, recalling that the company’s stock is hovering somewhere between $600 and $700 per share right now. The pay isn’t the problem — he gets $16 an hour, but he’s been out of town for a while, caring for a sick family member, and has just returned. He got his job back, but only part-time, and he lost his home.

He’s wary of being on welfare — that’s not the way his mother raised him — but he’s in the County Adult Assistance Program, which gets him $29 every two weeks, a guaranteed bed at the shelter, and a spot on a waiting list for a single-room-occupancy hotel room, the bottom rung on the permanent-housing ladder.

What he really wants is a studio, but his searches haven’t turned up anything affordable. He needs a little boost of cash for a security deposit on an apartment, but when he asked the General Assistance Office if it could help him out with that, the answer was no.

His brow furrows with concern, and then the conversation turns to me. "You got a job?" he asks.

What can I say? I’m a reporter for a local newspaper. I’ve heard that some of the city’s homeless shelters are lacking basic standards, accessing a bed can be complicated, and services are scattered. I thought I’d come find out for myself.

Here’s what I learned: San Francisco has a cumbersome crazy quilt of programs, stitched together with waiting lists and lines. Policies that are written on paper and espoused in City Hall are often missing in shelters. Some rules don’t seem to exist until they’ve been broken. Others apply to some people, but not all. Getting a bed is a major hurdle, and I say that as a stable, able, mentally competent, sober adult.

And once you’re in, it’s sort of like sitting in a McDonald’s for too long. Years ago a friend told me the interiors of fast food restaurants are deliberately designed to make you feel a little uncomfortable. They don’t want you to get too cozy; they want you to eat and leave, making way for the next hungry mouth they can feed.

In other words, shelters are designed to make people not want to use them.

The only information I took with me was a one-page handout I got from a San Francisco Police Department Operation Outreach officer. He said it’s what cops and outreach workers give to people they come across who are sleeping on the streets. I figure if it’s good enough for them, it’s all I need to navigate the system.

The map, as it were, is a cramped, double-sided list of places to get free meals, take showers, store your stuff, sober up, and, of course, get a bed.

For the bed, it instructs, you have to go to a resource center and make a reservation. Some of the resource centers are also shelters. Some aren’t. Some are just reservation stations. They all have different operating hours and are located all over the city, but mostly in the Tenderloin and South of Market.

It takes me a while to puzzle out which ones are open, where exactly they are, then which is closest to me. Phone numbers are also listed, so I assume it’s like making a hotel reservation and dial one up on my cell phone.

The first number doesn’t work. There’s a digit missing. Dialing methodically down the list, I discover that none of the numbers connect me to a person. This is obviously not the way to go.

The way I ultimately get into a shelter is not the way you’re supposed to. In San Francisco’s system, you’re not supposed to just walk up to a homeless shelter and get a bed, but that’s what I do.

At first the woman behind the counter at MSC South tells me the only open beds are across town, at Ella Hill Hutch in the Western Addition. Then another staffer looks at the clock and says he’s not sending me out there. He’ll "drop" beds instead.

The city’s 1,182 beds for single adults are managed through an electronic database called CHANGES. It’s a modern-day improvement on people roaming from shelter to shelter everyday, putting their names on lists for possible beds. Launched in 2004, CHANGES now does that electronically and maintains profiles of people who use the system. If you’ve been kicked out of a shelter, missed your tuberculosis test, or not shown up for curfew, CHANGES knows and tells on you.

Every day around 8 p.m. shelter staff trawl through the reservations and drop the no-shows, cancellations, and reservations that have expired or whose makers have moved on to hospitals, rehab, the morgue, or — less frequently — housing.

MSC is allowed to make reservations for any shelter except itself — that’s against policy. I learn this the next morning, and I’m told it’s because there’s too much corruption and favoritism. MSC is apparently one of the better shelters, so to keep clients from cutting deals with staff, the policy doesn’t allow clients to reserve a bed there.

But after half an hour the staffer hooks me up for a two-night stay, bending the rules to do so. While I’m waiting, he turns away a client who had a seven-day bed but didn’t show up the previous night. The guard confiscates his fifth of vodka, and he gets an earful about drinking.

When the city’s shelter system was born in 1982, it was first come, first serve at the doors of churches and community centers. President Ronald Reagan’s cuts to federal domestic spending landed hard on low-income people, so then-mayor Dianne Feinstein called on local organizations to temporarily house and feed the growing number of street sleepers.

Throughout the ’80s wages stagnated while the cost of living soared: between 1978 and 1988 the average rent for a studio apartment in San Francisco jumped 183 percent — from $159 a month to $450. Twenty years later it’s $1,114. In 1978 the Housing and Urban Development budget was $83 billion. Today it’s $35.2 billion, almost nothing by federal budgetary standards, and almost no new public housing units have been built since 1996, while 100,000 have been lost.

Every year the federal government spends almost twice as much on a single attack submarine as the Department of Housing and Urban Development spends on homeless assistance. State and local governments have been left to pick up the hefty price tag.

San Francisco spends more than $200 million on homelessness, through services, financial aid, supportive housing, emergency care, and shelter beds. There are 13 city-funded shelters, four resource centers, and three reservation stations in San Francisco. The Human Services Agency spends $12.5 million per year on shelters through contracts with nonprofit managers. The Department of Public Health also manages two contracts, for a battered women’s shelter and a 24-hour drop-in center.

But it’s not enough: the nonprofits supplement operating expenses with grants and private donations and recently relied on a special allocation of $300,000 to purchase basic supplies like soap, towels, hand sanitizer, sheets, pillows, and blankets.

James Woods, a spry 51-year-old wearing a red Gap parka barely zipped over his thin, scarred chest, rattles off the places he’s lived: Detroit, Atlanta, Seattle, San Francisco, Louisville, Ky., and his hometown, Nashville, Tenn. "Out of all the cities I’ve been in, this is the only city where you have to go and make a reservation for a bed at the rescue mission all the way across the city in order to come back to the place you started," he says, jabbing the floor of MSC with his cane. "I can’t even make a reservation here for a bed here. They’ll send me across the city to another place to do that."

Woods has been pounding the pavement between MSC and the Tenderloin AIDS Resource Center for eight months. Every day around 3:30 p.m. he heads to the Tenderloin, where he gets in line for a bed. Woods has a fractured hip and arthritis, pins in his knees and feet, and hepatitis C. He’s been HIV-positive since 2002. He walks with a limp that can transform into a springy, stiff-legged canter when he chases the 27 bus down Fifth Street.

Rather than tote all of his possessions with him, he hides them in the drawer of an emergency bed at MSC, so it’s imperative that he get back there every night. Sometimes he waits hours for an MSC bed to open up.

Though Woods speaks highly of some city services, swooning a little when he mentions his doctor at the Tom Waddell Health Center, the daily bed hunt has left him exhausted and disgusted with the city. "They’ve got the program designed to run the homeless off," he says. "They have it as hard and difficult as possible for you to take a breath, take a rest, get a routine."

While a person can reserve a bed for one to seven nights and, if on General Assistance, make arrangements through a caseworker for 30- to 90-day stays, Woods has rarely been able to procure a bed for longer than one night. "Maybe twice I’ve gotten a seven-day bed," he says.

The inability to connect people with beds is not lost on city officials. Mayor Gavin Newsom’s recently hired homeless policy director, Dariush Kayhan, told me, "I really want to solve the issue of the juxtaposition of vacant beds and homeless people on the streets. That to me is untenable."

However, he only discussed the issue in terms of people who’ve chosen not to use the shelters and are sleeping in the street. To him, empty beds signify that there’s more than enough shelter for people. "At this time there’s no plan to expand any shelter beds, and I think homeless people, in many ways, many of them vote with their feet and have decided that shelter’s not for them," he said.

But the Guardian found that even if you are willing and waiting for a bed in a place where someone can presumably connect you with one, it often doesn’t happen.

According to the 2007 Homeless Count, there are 6,377 homeless people in San Francisco. The nine year-round single-adult shelters have enough beds to accommodate one-third of that population. Other emergency facilities shelter some of the overflow on a seasonal basis. The remaining homeless sleep in jails and hospitals, respite and sobering centers, parks and sidewalks.

People also pile up at Buster’s Place, the only 24-hour drop-in resource center in the city, where they slump all night in chairs, forbidden by staff to sleep on the floor.

It took Guardian writer Bryan Cohen five nights to find a spot at a shelter. He spent Jan. 20 and 21 at Buster’s waiting to see if a bed would open up. None did. According to the shelter vacancy report for those two nights, there were 108 and 164 beds set aside for men that went unfilled. On an average night this January, a month marked by cold weather and flooding rain, 196 beds were empty.

Buster’s does not have access to CHANGES but can apparently call shelters and ask about empty beds. I was at the Providence Foundation shelter one night and overheard a call come through and shelter staff tell whoever rang that no, they couldn’t bring more people here. There were four empty mats beside me.

Laura Guzman, director of the Mission Neighborhood Resource Center, said CHANGES was a breakthrough in getting people into beds, but when it was first launched in 2004, things were different. "You had a choice. Shelter of choice was much easier to achieve. Then Care Not Cash happened," she said.

Most of the city’s beds are assigned to beneficiaries of certain programs, like Swords to Ploughshares and Newsom’s signature plan Care Not Cash, or to people with mental health or substance abuse issues who have case managers.

Though beds can be turned over to the general public when they are dropped after curfew, one wonders how effectively that happens.

The challenges are worst for Latinos, refugees, and immigrants, who face language barriers and the potential hurdle of illegality.

As a result, they flood one of the few places they can get in. Dolores Street Community Services reported the second-lowest vacancy rate in January, just 5 percent. The 82-bed program hosts a waiting list and is one of the more flexible in the city — deliberately so, as many of its Latino participants have jobs or work as day laborers. Marlon Mendieta, the executive program director, says, "They have a plan and just need to save up some money to move into a place."

However, rising rents have made moving on difficult. "We have people who are basically just cycling from one shelter to another," Mendieta said. "We see some who exit our shelter, find housing, but might end up back at the shelter if rent goes up or they lose work."

Providence is one of the sparest of homeless facilities and is located in a Bayview church. Unlike at other shelters, there’s no hanging out here. When the doors open at 9:30 p.m. about 90 people with reservations are already lined up in the rain on its dark side street.

We receive one blanket apiece, and the men shuffle into the gym while I follow the other females into a smaller side room, where 12 mats are laid out on two ratty tarps. Several women immediately lie down, speechless.

The cook gives a quick blessing when plates of food arrive on two sheet pans: spaghetti, heavily dressed salad, limp green beans mixed with cooked iceberg lettuce, and a very buttery roll. It’s all heavy and slightly greasy, but also warm and a closer approximation of a square meal than any of those offered by the other shelters I’ve stayed in so far.

Moments after I finish eating the lights are turned off, even though a couple of women are still working on their meals. A shelter monitor comes through and confiscates our cups of water, saying she just refinished the floors in here and doesn’t want any spills. I notice that unlike at other shelters where I’ve stayed, none of the women here have bothered to change into pajamas. Some haven’t even removed their shoes. I follow suit, tucking my jacket under my head for a pillow and pulling the blanket around me.

When the lights come back on at 5:45 a.m., I understand why no one changed: there’s no time to get dressed. Shelter monitors enter the room, rousting sleepers with catcalls to get up and get moving. One turns on a radio, loud. They’re brisk and no-nonsense, grabbing blankets and shoving them into garbage bags, pulling mats into a stack at the edge of the room.

A woman becomes perturbed by being hustled and talks back to the shelter monitor. A verbal battle ensues, with the client picking up her mat and throwing it across the room, scattering her possessions. "What a woman, what a woman," the shelter monitor yells. "We’ll see if you get a bed here tonight."

Another staffer comes through with a toxic-smelling aerosol, which she sprays around us as we get ready to leave. The bathroom, the cleanest I’ve come across in the city’s shelter system, is still a clusterfuck as a dozen women wait to use the three toilets and two sinks. One stall has a broken door, and the only morning conversation is apologies to the occupant.

Even though the contract between Providence and the HSA says the former will provide shelter until 7 a.m., it’s a little after 6 a.m. and all 90 of us are back out on the street, rubbing sleep from our eyes, shivering in the dark dawn, and waiting for the Third Street T line. When the train comes, most of us board without paying and ride back toward the city center to get busy finding some breakfast and making preparations for where to stay tonight. I have four hours before I have to be at work.

Shucrita Jones, director of Providence, later tells me the shelter’s materials have to be cleaned up by 7 a.m. because the church is booked for other activities. "We turn the lights on at 6. The clients have at least until 6:10 to get up. We encourage everyone to be out of there by 6:15 so we can be clear of the building by 6:30," she says. To her defense, she adds that the shelter monitors often let people in earlier than the contracted time of 10 p.m. and that when the weather is particularly nasty she’ll open the doors as early as 8:30 p.m. to let people in out of the cold.

As for the discrepancy between empty mats in the shelters and people going without beds, she blames the reservation system. "CHANGES has a lot of glitches," she says. "It’s got a lot of errors the city and county [are] trying to fix."

What I witness isn’t as bad as what I hear. In the shelters everyone has a horror story — some are about how they got there, others about what’s happened to them since they arrived. Nearly all include a questionable experience with staff — from witnessing bribes for special treatment to being threatened with denial of service for complaining. Their observations echo mine: the administration and certain high-level staffers exhibit genuine concern and an ability to help when you ask, but lower-tier workers aren’t as invested in providing good service.

Tracy tells me she sent her daughter to private school and considers herself a victim of the dot-bomb era and an illegal eviction that landed them at the Hamilton Family Center. "We were given one blanket. It was filthy. It had poo on it, and, I’m not kidding, there were even pubic hairs," she says.

She describes the shelter’s intake process as similar to that of jail bookings she’s seen on television. Six days later she and her child were thrown out. No reason was given, though she’s convinced it’s because a staff member overheard her complaining about a recent incident involving another client sneaking in a gun. When she was told to leave immediately, she wasn’t informed that she had the right to appeal. So she and her daughter hastily gathered their things and hit the dark Tenderloin streets.

A grievance system exists for people who’ve been hit with denial of service, or DOS’d, the colloquial term for kicked out. But the process can take months. Shelter managers I spoke with don’t deny that stealing is rampant, favoritism exists, and complaints occur — the greatest number about staff and food.

General complaints are supposed to be handled within the shelter, though they may be copied to the city’s Shelter Monitoring Committee. The SMC submits quarterly reports to the Board of Supervisors, Mayor Newsom, and the public, which show regular instances of inconsistent and unsafe conditions, abusive treatment, and a lack of basic amenities like toilet paper, soap, and hot water.

Those reports prompted Sup. Tom Ammiano to sponsor legislation mandating standards of care for all city-funded shelters (see "Setting Standards," 1/30/08). The new law would create baseline standards and streamline a complaint and enforcement process.

According to the HSA, many of these standards are already policies included in the contracts with the nonprofits that run the shelters, requirements such as "provide access to electricity for charging cell phones."

During my stay at the Episcopal Sanctuary, I asked the shelter monitor on duty where I could plug in my cell phone and was told I couldn’t. When I asked why not, the only reply was that it’s against shelter policy. At Ella Hill Hutch Community Center, Cohen was told he could plug in but at his own risk — his unattended phone would probably be stolen.

I reviewed all of the contracts between the city and the nonprofit shelter providers, as well as the shelter training manual that’s given to staff. I was unable to find the same list of policies the HSA gave to the budget analyst. I asked HSA executive director Trent Rhorer how these policies have been communicated to the shelter staff, but he did not respond by press time.

While the ability to charge a cell phone seems relatively minor, its ramifications can be huge. The first time James Leonard met with his case manager at Next Door shelter, he knew exactly what he needed to get back on his feet: bus fare to get to and from three job interviews he’d already scheduled, a clothing voucher so he’d have something nice to wear when he got there, and a couple of dollars for the laundry facilities at the shelter. He also needed to charge his cell phone to confirm the interviews. He said he was denied all four things.

The standards of care, if passed, could improve access to those basic provisions, but some in the Mayor’s Office have balked at the estimated $1 million to $2 million price tag. The budget analyst’s final report is scheduled for release Feb. 14, in time for a Feb. 20 hearing at the Budget and Finance Committee.

Deborah Borne, medical director of the DPH’s Tom Waddell clinic, is a proponent of the standards from a public health perspective. "For me, I’m looking at decreased funding and how can I best affect the most population with what remains," she said.

Dirty shelters can help spread disease outside their four walls, as clients leave every day to use municipal services like buses, libraries, trains, and restaurants, which we all enjoy. Borne says this is something that’s been tackled by other facilities that house large numbers of people and is long overdue in the shelters.

"You can argue about whether we should or shouldn’t have shelters, but there are no city, state, or federal regulations for them. There are tons of regulations for the army, for public schools and colleges, but we put people in shelters and there’s none," she said. To her, San Francisco is on the cutting edge of care with this legislation. "I can’t wait until we do this on a state level," she said.

Kayhan said he and the mayor support the spirit of the legislation and have no problems with most of the no-cost items, but the price tag for staffing, training, and enforcement is a concern. "I think when you’re looking at how much money you’re going to spend on homelessness overall," he told us, "I would rather allocate additional resources to create another unit of housing for someone as opposed to enhancing the service model of the shelters."

Every day he’s on duty in the Tenderloin, police captain Gary Jimenez comes across homeless people — or people who seem homeless but aren’t.

"One day on Turk Street, I came by a long line of people drinking. I was walking with a Homeless Outreach Team officer, and he said he knew them all. Only about 20 percent of them were actually homeless. They don’t want to sit in their rooms drinking. We give people housing but we don’t acclimatize them, get them used to being inside. They want to do what they’ve been doing, and they go out on the streets to do it. It’s social," he said.

Larry Haynes agrees. "It’s lonely and depressing in your room," he says. He lost his Beulah Street apartment through an Ellis Act eviction and has been living in the Vincent Hotel for three years, after a nine-month stint in the shelter system. He’s a tenant representative now, advocating for improved conditions in the SROs, which still beat the shelters.

"The criticism I hear from people on the streets is that there are some good shelters but you can’t get in them," Jimenez said. "Then there are shelters that are open that you can go to, but you wouldn’t want to because they’re really bad."

He tells me he’s visited shelters but finds it difficult to get a feel for how valid the complaints are. "I can’t tell without waking up there or knowing what it’s like to be thrown out on the street at 6 a.m. in the cold when there’s nothing open," he said.

The Shelter Monitoring Committee has requested that HSA staff stay in shelters at least once to get firsthand experience, but it’s yet to receive confirmation that this has occurred. When we asked Rhorer about the policy, he said, "There are 1,800 employees who work for HSA, so there is no way of knowing if any of them have been homeless and used the shelter system."

In our first conversation, Kayhan told me he had never stayed in a shelter. In a later interview, when I asked what he thought about the public perception of the shelters, he said, "I’m just not sure that the criticism that I hear around the shelters as being dangerous hellholes — or whatever has been said — matches what I see in the shelters or what I read with respect to incident reports or what I hear at the Shelter Monitoring Committee or at the shelter directors’ meetings. So perception is reality."

"Housing first" has been Mayor Newsom’s modus operandi for handling homelessness, and it’s a good one — the idea being to stabilize people, whatever condition they’re in: drunk or sober, clean or using, ill or able, young or old, alone or with family.

The city’s 10-Year Plan to End Chronic Homelessness, released in 2004, recommended 3,000 units of supportive housing to get the chronically homeless off the streets. Kayhan confirms the Mayor’s Office of Housing is on track to meet that goal through master-leasing SROs and building or renovating new affordable units, where occupants will get supportive services.

The chronically homeless, a catchall term for folks who stick to the streets and don’t or aren’t able to use the system, have been the mayor’s target and Kayhan’s priority. This makes sense because they’re the most visible face of homelessness.

Last year’s city budget allowed a tripling of staff for the Homeless Outreach Team, which works diligently to move the most entrenched homeless off SoMa side streets and out of encampments in Golden Gate Park. A special allocation of shelter beds was set aside for them, and those who refused shelter were put directly into stabilization units in SROs, bypassing the shelter system entirely.

For some, this has been great. It’s how Leonard finally started to make some progress. He bailed on the shelters after having his possessions thrown out three times by staff and hit the streets, where HOT found him, deemed him "shelter challenged," and moved him into a stabilization unit.

"I feel almost as good today as the day before I became homeless," he tells me one afternoon in January. The Bay Area native is hoping to transition into a subsidized rental soon.

Twenty-five percent of shelter staff are required to be homeless or formerly homeless. Some shelters hire up to 80 percent. Tyler is one of them — he lives at MSC South but works for Episcopal Community Services, which runs Sanctuary, Next Door, and the Interfaith Emergency Winter Shelter Program. He shows me his pay stub to prove it, and I note that every two weeks he takes home more than I do. "Yeah, I make good money," he agrees.

He’s been looking for an apartment, but rents are high and he hasn’t found anything good. A plan to move in with a family member fell through, so he’s just hanging out on the housing wait list. "What I really want to do is see what they’re going to do for me. I’ve been on [Personal Assistance Employment Services] for six months. Where is my SRO if I can afford to pay for it? So obviously that shit doesn’t work," he says.

He’s bitter about the effect the Golden Gate Park sweeps have had on the SRO stock. "They got SROs right away," he said of the 200-plus people who were removed from the park by HOT, put into stabilization beds, and transitioned to SROs. "They took them right away ’cause Gavin had to clean that shit up," he says.

Tyler, like many people I spoke with, keeps as sharp an eye as possible on City Hall. They read the papers and have opinions informed by firsthand experience about programs like Care Not Cash. They know Kayhan is making $169,000 per year and they’re making $29 every two weeks.

One morning, coming out of the bathroom at Sanctuary, I stop to study a posting for affordable housing on a bulletin board. It’s a studio for $863 per month, more than I pay for my one-room Mission flat. The longer I stay in the shelters and the more people I talk to, the less secure I feel in my economic stability.

Ruby Windspirit has been homeless since Jan. 14, two days before I started my tour of the shelters. The 59-year-old Irish Navajo was attending school in Portland, Ore., studying photography and science, when she became ill with bone cancer. She came to San Francisco to convalesce closer to her daughter, who lives in a one-bedroom apartment in the Castro with three other people.

Windspirit knew she couldn’t stay on the couch for too long and made a reservation for a $27 per night hotel in the Tenderloin. Despite the reservation, she couldn’t get in for two days and the bed she was ultimately given was two box springs with a piece of plywood for support. The sheets were dirty. She left after two weeks and entered the shelter system. She says Next Door is "150 percent better" than the hotel. She has a bed off the floor and the extra blanket her doctor recommended, though she was scolded for trying to plug in her phone.

I try to imagine what people like Windspirit would do if there weren’t shelters. But the Ten Year Council also recommended a phasing out of shelters within four to six years, to be replaced by 24-hour crisis clinics and sobering centers.

There are 364 fewer shelter beds in San Francisco than when Newsom became mayor. This year more may go. The city is currently requesting proposals to develop 150 Otis, which serves as a temporary shelter and storage space for homeless people, into permanent supportive housing for very-low-income seniors. About 60 shelter beds will be lost.

The HSA confirmed there are currently no plans to open any more shelters in San Francisco. The last plan for a new shelter — St. Boniface — fell through, and the money that was set aside for the project still languishes in an HSA bank account. Midyear budget cuts proposed by the mayor put that money on the chopping block.

Buster’s Place is also on the list of cuts. By April 15, the only place where someone can get out of the elements at any time, day or night, could be closed for good.

Kayhan, who previously oversaw Project Homeless Connect, Newsom’s private-sector approach to the problem, agreed that shelters will always be needed. What he worries about are the people who become dependant on them and refuse housing offers, although he’s also thinking about ways that shelters could be more amenable.

"I’d like to look at the next step with Homeless Connect to try and institutionalize that in the way we do business specifically in the shelters," he said, imagining a shelter pilot of one-stop shopping for services.

But just three weeks into his new job Kayhan was reaching out to constituents to try to figure out what isn’t working. He told us, "What I’m trying to do since I came into this position is be on the street and measure the impact the system is having on those that are on the street day in and day out and try to see what part of the system isn’t working properly or needs to be resourced differently so that we don’t see homeless people, long term, on the streets."

One night at MSC, in the bathroom before bed, a young woman tells me her story while I brush my teeth and she washes off her makeup. Not too long ago she drove here from Florida to meet up with her boyfriend. They were hanging out on the street one night when a cop came by, cited him for an open container, and discovered he had a warrant. Now he’s in jail in San Rafael.

She started sleeping in her Suburban while she looked for job and a place to stay. One night while she slept, parked at Castro and Market, she was hit by a drunk driver. She lifts a hank of long blond hair and shows me a bright pink tear of stitches above her temple. An ambulance took her and the drunk to the hospital. Her totaled car was towed. When the hospital found out she had no place to go, it sent her here.

"Now I’m in a fucking homeless shelter," she says, genuinely aghast at the situation and truly lost about what to do. She has her bed for five more days.

She could get a job. She says, "I have hella references," from working in restaurants for years. She could sleep in one of her friends’ cars, but it seems like so much work: waking up in the car, going to a resource center or shelter to wash up, then going to work.

We joke about living in the shelter. "Yeah, you can come over," she imagines telling her friends. "Dinner’s at 4:30."

"You’ve got to leave by 10," I say.

"It’ll be fun. We can hang out and smoke on the patio," she says.

I don’t know what else to say, except "Good luck." I know what it’s like to chase a boyfriend to San Francisco. I remember sleeping in my car when I was 21, during a strange time between graduating from college and getting a place to live for the summer in a town where housing was tight. I think about my little sister, packing up her Subaru one day and taking off to Miami, where she didn’t know a soul. You have a little money, a lot of hope, and that youthful sense of invincibility, but sometimes it all comes down to luck.

I bid her good night, pack up my toiletries, and wipe my face with my shelter-issued towel. It smells vaguely of bleach and shit.

GREEN CITY You may be the greenest, most permacultured locavore with a heart made of hemp. You tend your community garden on dates, travel only by biodiesel bus, and make your Christmas gifts from recycled materials rather than contribute to our culture’s overconsumption of resources. But chances are you haven’t thought about how your sex habits are affecting the planet — not to mention your partner. And what better time to think about it than the week of Valentine’s Day, the date when couples feel entitled to sex and singles are saddest about not having any? (Or is that the other way around?… But I digress.)

`Thing is, your favorite dildo may be releasing deadly toxins into the environment. Your discarded butt plug, so small and cute and seemingly innocent, may spend several centuries in a landfill before it degrades — if it ever does. Your vibrator could be the reason for someone else’s unnaturally tiny penis. Really.

The issue with sex toys — one of the more recent industries to be examined through a green lens — is twofold: disposal and toxicity.

The first is the easier, less contentious, and somewhat more obvious issue. Since we’re talking about a variety of objects often made of plastic, PVC, rubber, electronics, and other nonbiodegradable materials, it makes sense that concern has been raised about where sex toys end up and what happens to them when they get there. Just like water bottles and discarded train sets, sex toys made from these materials seem destined to last longer on the earth than any of us will — causing more pain in the long term than pleasure in the short term.

The second issue is whether sex toys are safe for humans, both those who use them and those who may be exposed to them through the environment. The concern here is phthalates, a variety of chemicals most commonly used to soften hard plastics but also found in cosmetics, food wraps, and a number of other ubiquitous consumer goods — and until recently, often used in plastic-based sex toys. There has been substantial research suggesting that phthalates — chemicals not naturally occurring in the human body — are present in 90 percent of Americans’ bodies. Furthermore, scientists believe phthalates can have a detrimental effect on male reproductive development.

"Severe interference can involve incomplete development of the penis, undescended testicles, decreased testosterone levels," Tracey Woodruff, director of the Program on Reproductive Health and the Environment at the University of California at San Francisco, told the Guardian. "There can be lifelong consequences."

Are there counterarguments to all of these worries? Sure. For starters, there’s always the issue of how green to go. Should you worry more about your rubber dildo — which you may keep for 10 years — than about your plastic shower curtain, which you’ll throw in the landfill in three months? Or is this just the latest ecofriendly phase our culture (and media) is going through? And as for phthalates, there are lots of different kinds — and no one is exactly sure what they do or how they do it.

But if you’re anything like Coyote Days, buyer for Good Vibrations, you’ll figure safe is better than sorry. Days said the major sex toy retailer has decided to phase out products containing phthalates, just in case it turns out the chemicals really are as bad as scientists suspect. In particular, Days suggested replacement with silicone varieties, if you can afford them.

And if you’re worried about how well a sex toy will biodegrade, you can always opt for a metal, wood, or glass variety.

In fact, if you’re feeling really ambitious, you can check out the P Aqua from Love Piece, a dildo made from seaweed and water that, while solid at room temperature, can be boiled to oblivion for Earth-friendly disposal. (Though the company asks you to notify it if the dildo has a sour odor. Ew.)

As for Good Vibrations’ future inventory? Day said, "We’re not quite at the seaweed and water level yet." Me either. But I’m hoping for a sushi restaurant tie-in when this thing gets big. Buy one California roll-in-the-hay, get one seaweed sex toy free? I like it.

Cleaning up the shelter mess

EDITORIAL Shelters aren’t a solution to homelessness. Everybody knows that; everyone agrees. But in San Francisco the shelter system that was set up as a short-term patch to address the growing number of homeless people on the streets in 1982 has, over a quarter century, become a fixture of city life. And as long as the federal government continues to abandon cities and affordable housing and create poverty, this is not likely to change any time in the immediate future. Even the most ambitious local housing program — and there will be a fairly ambitious one on the November ballot — isn’t going to create an immediate and permanent place for all of the 8,000 or so people in this city who can’t afford a place to live.

So shelters are going to be with us for a while — and it’s inexcusable that the city continues to operate them under such horrible conditions.

As Amanda Witherell reports in this week’s cover story, the shelter network is a bureaucratic nightmare. Clients get bounced all over town, it’s almost impossible to reach any of the shelters by phone, and the directions you have to follow to get a bed are complicated and confusing. Although everyone knows that shelters are now more than temporary housing, it’s hard at some shelters to get a bed for more than one night; lots of homeless people spend four or five hours per day waiting in lines for a shot at a bed (and even after that, some wind up not getting a place to sleep). The shelters — mostly run by nonprofits under city contracts — have the feel of prisons; they are strictly regimented and often unsafe and lack even basic amenities like soap. Clients often have to ask for toilet paper.

In 2006 the city’s Shelter Monitoring Committee found that only 6 of the 19 San Francisco homeless facilities met even basic standards for hygiene and sanitation. Fifty-five percent of shelter clients who participated in a May 2007 survey by the Coalition on Homelessness reported some kind of physical, sexual, or verbal abuse. One-third had no access to information in their native language. Thirty-five percent had nothing to eat.

It’s no surprise that many homeless people would rather sleep in Golden Gate Park — and as long as the abysmal conditions persist, that problem will continue.

The city’s not in the position to create luxury hotels, but it can make the shelters a lot less degrading, dehumanizing, and unpleasant. Sup. Tom Ammiano has already vowed to introduce legislation that would mandate minimal standards of care, and the Board of Supervisors needs to pass a tough bill as soon as possible.

Among the things that need to be addressed:

Basic public health The Department of Public Health is concerned that the shelters can be breeding grounds for disease, and that’s a serious problem: there have been some close calls with tuberculosis, and bedbugs are a chronic issue. Many of the shelters lack such basic supplies as hand sanitizer, soap, rubber gloves, and clean towels. For just $15,000, public health nurses from the city’s Tom Waddell Health Center, working on a pilot project, were able to make significant inroads in hygiene and sanitation in two shelters. They’re now moving on to attack bedbugs and scabies. That approach should immediately be expanded to every shelter in the city.

Safety Some of the shelters, particularly the men’s shelters, are lacking in basic security measures. It would be nice to have full-time security staff in every facility, but that might be expensive. At the very least, the staffs need more security and violence-deescalation training, the centers need to have operating and functional locks, and the city needs to mandate that the places are safe enough that clients aren’t afraid to stay there.

A ridiculous bureaucratic labyrinth and lack of coordination Nobody should have to stand in line for three hours per day just to get a reservation for a shelter bed. Nobody should have to trek across town (on foot or on Muni, without the bus vouchers that the shelters ought to be giving out) from one shelter or homeless service center to another just to find out where to stay. There ought to be a one-stop shop (or a series of them) where a person can check in anytime during the day, find a shelter, line up a bed, get a ticket, and be on his or her way. City officials don’t talk much about this, but many of the shelter residents have jobs; they go to work all day but still can’t afford a place to live in San Francisco. The hoops they have to jump through make the system brutally unfair.

A lack of reality Mayor Gavin Newsom says he wants to get beyond the shelters, to use them only as entry points into a system that will find treatment, counseling, job training, and permanent housing for all homeless people. We want that too. So does just about everyone who cares about this issue.

But the mayor also talks about getting rid of aggressive panhandling, and he and his supporters complain about the people on the streets who hassle tourists. And nobody seems to want to admit that many of the folks who are typically lumped under the term homeless actually have homes.

The city has managed to lease, renovate, and otherwise make available hundreds of single-room-occupancy rooms, and quite a few formerly homeless people have found long-term residences there. But the mayor’s Care Not Cash policy ensures that most of the modest welfare payments these people get are seized by the city for their housing, leaving them with nowhere near enough to survive. So they panhandle — is anyone surprised?

It may sound radical, but if the city, state, and federal cash grants to people who for whatever reason can’t find work were increased to a level that would support a tolerable lifestyle in one of the world’s most expensive cities, a lot of the quality-of-life problems Newsom bemoans — and that the city spends millions trying to mitigate with law enforcement resources — might go away.

Meanwhile, the shelter residents who do have jobs or who are looking for jobs spend so much of their lives trying to navigate a Byzantine system that they have little in the way of waking hours to improve their economic prospects.

The disaster that is San Francisco’s shelter system is the legacy of many years of public policy that allowed the interests of developers, landlords, and speculators to trump the needs of the city as a whole. The housing crisis isn’t going away tomorrow — but the victims have a right to a basic level of human decency. The supervisors need to make that happen, with dispatch.

Political football season

With Mayor Gavin Newsom predicting a big budget deficit and seven Board of Supervisors seats up for grabs, everyone knew 2008 would be acrimonious.

But few suspected the war between Newsom and the supervisors would get so nasty so soon, even before the lunar Year of the Rat had officially dawned. The most telling development was the swift and nasty retaliation board president Aaron Peskin endured after he requested that Newsom return the $750,000 the mayor siphoned from the San Francisco Municipal Transportation Agency to pay the salaries of seven mayoral aides.

At the Jan. 29 Board of Supervisors meeting, Peskin publicly called for "an end to the budget shell game that has resulted in monies being shifted from Muni and other city departments to fund political employees who do not work for or directly improve services for the departments paying for their positions." Newsom’s predecessor, Willie Brown, was the master of such budget games, but Peskin said, "There are those who defend this shell game by saying it is a long-standing practice here at City Hall. That may be true. But it doesn’t make it right."

Peskin’s demands came at a horribly awkward moment for Newsom: two months earlier the newly reelected mayor announced an immediate hiring freeze and across-the-board cuts to city departments, citing a projected $229 million budget deficit in fiscal year 2008–09. His administration blamed this looming deficit in part on the creation of 700 new city positions, including 100 new police officers and 200 public health nurses, plus pay raises for nurses, firefighters, and police officers.

Also blamed were a projected windfall loss of property transfer taxes and a bunch of voter-approved spending requirements, including the November 2007 voter-approved and Peskin-authored Proposition A, which transfers $26 million more annually from the city’s General Fund to the MTA.

Newsom press secretary Nathan Ballard defended the use of MTA funds to pay mayoral staff salaries, claiming that all but one of the positions have a direct relationship to the work of the MTA, including the new director of climate change initiatives, Wade Crowfoot. "I know it’s not pretty, but it is an efficient way of getting city business done. We are following the letter and the spirit of the law," Ballard reportedly told the San Francisco Chronicle.

But within a week the mayor’s point person on transportation, Stuart Sunshine, announced he’ll be leaving City Hall in February, while the Mayor’s Office scrambled to explain why Brian Purchia, who developed Newsom’s reelection campaign Web site last year and who last month started working in Newsom’s press office for $85,000 per year, was hired as an MTA employee.

"The MTA has not and will not be paying any part of his salary," Ballard responded by e-mail Jan. 24 to a Guardian inquiry. "As of January 28, Purchia will be on a Mayor’s office requisition." Ballard also blasted Peskin in the Chronicle and the San Francisco Examiner, using incendiary language normally reserved for political campaigns and rarely employed by city employees talking about the president of the Board of Supervisors.

Retaliation for Peskin’s publicly announced MTA refund request has also included two splashy Chronicle hit pieces attacking Peskin and the board that ran on the front page, above the fold, on two consecutive days. One includes a photo of Peskin alongside extracts from a five-month-old letter that was possibly leaked by the Mayor’s Office (the confidential letter was copied to Newsom chief of staff Phil Ginsburg) in which Port of San Francisco director Monique Moyer alleges that Peskin made bullying late-night phone calls last August, when the Port was trying to get a measure passed to increase building heights along the Embarcadero — a land-use issue that was resolved last year.

But Peskin isn’t the only elected official to get his wrists slapped by the mayor in recent weeks.

In mid-January, Newsom upbraided San Francisco’s entire delegation in Sacramento for lending their support to the board-approved affordable-housing City Charter amendment, which will be on the November ballot and seeks to set aside $33 million annually in affordable-housing funds for the next 15 years.

As Sens. Carole Migden and Leland Yee and Assemblymembers Fiona Ma and Mark Leno noted in a Jan. 7 letter to Peskin, local voters have not approved a renewal of the 1996 housing bond, and the board’s proposed amendment builds on prior successful ballot measures to fund libraries, parks, and children’s programs, which have been successfully implemented without significant budget impacts.

But Newsom wrote the delegation Jan. 11 to express his "disappointment."

"I cannot support the Charter Amendment, because it has significant implications for the future fiscal health of our City and the backbone of our public health care system — San Francisco General Hospital," Newsom claimed, noting that the General Hospital bond is also on the November ballot. Then again, Newsom is also backing a Lennar Corp.–financed measure that would approve the building of 10,000 housing units at Candlestick Point but wouldn’t guarantee affordability levels (see "Signature Measures," page 10).

Meanwhile, fearing that Newsom is seeking to exert excessive control over several key commissions, the Board of Supervisors’ progressive majority is seeking to ensure that the seven members of the MTA board are elected officials beginning November 2009 and to divide the power to nominate members of the San Francisco Public Utilities Commission between the supervisors and the mayor.

These moves are coming at a time when Newsom has decided to replace three members of the MTA board who had alternative-transportation credibility but whose loyalty he apparently questioned: San Francisco Bicycle Coalition executive director Leah Shahum, Peter Mezey, and Wil Din. To fill those slots, Newsom appointed disabled-rights activist Bruce Oka, attorney Malcolm Heinicke (both of whom served on the Taxi Commission, which Newsom hopes to merge into the MTA this year), and Jerry Lee, a member of the Transportation Authority’s Citizen Advisory Committee.

But the Board of Supervisors can block the mayor’s MTA picks — and that showdown looks likely, in light of Newsom’s alleged misuse of MTA funds and his refusal to heed Peskin’s call for a mayoral representative to appear before the board to explain Newsom’s vision for the MTA.

Meanwhile, Sup. Jake McGoldrick told the Guardian he introduced a Charter amendment to make the MTA board seats elected positions. He argues that Prop. A not only increased the MTA’s budget but also reduced the board’s MTA oversight, so the body now needs to be more answerable to San Franciscans.

"It’s about not having accountability at the legislative branch," McGoldrick said. "The MTA ridership and residents need to have a way to voice their concerns."

McGoldrick said the mayor’s early removal of MTA members and his raid on MTA funds are troubling.

"Their removal reinforces what’s going on, how the MTA is viewed as a milking machine for the Mayor’s Office," McGoldrick said, noting that he asked for a budget analyst’s report on the MTA several weeks ago to keep the discussion objective and that he also asked for an accounting of the 1,600 to 1,700 jobs that Newsom declared frozen last fall. That report should be available at any time.

"I wanted to see which jobs were frozen and which were defrosted," McGoldrick said, "but I didn’t want it to become a political football."

However, with battles between the board and the mayor likely to get even intenser during the coming budget and election seasons, it’s starting to look like 2008 could be one long political football season.

The governor’s spending addiction

OPINION Just five months after boasting that California’s "budget deficit is zero," Gov. Arnold Schwarzenegger recently came back to tell us the state is facing a staggering $14.5 billion shortfall over the next 18 months.

To deal with this amazing turn of events he is now proposing that we slash funding for our court system; virtually close down our state parks system; cut more than $4.5 billion from K–12 education; decimate our AIDS Drug Assistance Program; further reduce reimbursement rates for health care providers; put the children of mothers on state assistance at risk of homelessness; deny the blind, the elderly, and the disabled even a minimal cost-of-living adjustment; and continue to underfund our higher education systems.

Voters should rightfully be bewildered and seriously concerned. How and when did this crisis happen? How could the state go from a budget deficit of zero to one of $14.5 billion in just five months?

The governor’s earlier boast about our nonexistent budget deficit was a great line from a great showman. But it failed to tell the real story.

The fact remains that Schwarzenegger created the beginnings of this budget catastrophe on his very first day in office, when he followed through on a campaign pledge he made during the 2003 recall election. His promise was to rescind the restoration of the vehicle license fee.

The VLF was created in 1935 as a 1.5 percent tax on the purchase price of every automobile sold in California. Iconic Republican governor Earl Warren raised it to 2 percent in 1948. VLF revenue does not go to the state’s General Fund. Rather, it goes to local governments to pay for fire and police protection, keep libraries and parks open, and keep our streets clean.

In 1998, at the height of the dot-com boom, when California had surplus tax revenue, the Stage Legislature offered car owners a temporary relaxation on the VLF. The average 2 percent VLF was then $300. The "good times" tax break lowered the amount car owners paid to just $100. The state picked up the remaining $200 so local governments would continue to receive the entire $300. At the time this cost the GF around $5 billion annually. The deal was to continue as long as there were "sufficient general funds" to make up the difference.

In 2003, after the boom went bust, we faced a $38 billion state budget deficit. Then-governor Gray Davis’s finance director correctly determined that there were no longer sufficient general funds to continue the good times tax break. The VLF was restored to where it had been for 50 years.

Candidate Schwarzenegger seized on the issue, and the rest is history. Unfortunately, the $6.15 billion that Schwarzenegger is now spending annually on the VLF tax break is money we don’t have. Neither are the billions he’s spending to cover that debt, which stands at more than $20 billion over the past four years. Combined, the cost of the VLF tax break and the debt to service it account for almost 90 percent of our current budget deficit.

Without the governor’s reckless and profligate spending habit, our state would have no budget crisis and there would be no need to dismantle essential governmental services.

We need to finally have an honest conversation with the voters of California. One can debate whether or not the VLF spending program is a good idea. What is not debatable is that the ongoing GF cost of the VLF spending program is the main cause of our budget woes.

An immediate intervention is necessary. We must break the governor’s spending addiction to correct the course of our state.

There are plenty of stark contrasts between the Republican and Democratic presidential campaigns, starting with the fact that all of the Republicans sound like morons and both the Democrats have credible policy ideas that they appear to have thought about.

But the thing that struck me most in the week before the California primary was the tone of the GOP debate at the Reagan Library in Simi Valley, where John McCain, Mitt Romney, Mike Huckabee, and Ron Paul spent an inordinate amount of time arguing over who was the most authentic conservative.

The c word came up about every five seconds. I’m a right-wing conservative! No, no, I’m even more conservative. Hey, I’m so conservative I think all the immigrants ought to be lassoed with a chain and dragged back to Mexico behind a Hummer. Romney even hit McCain for winning the New York Times endorsement, saying that means he isn’t a real conservative.

And I wondered: what would the world be like if the Democrats were arguing over who was the best liberal?

Imagine if Barack Obama and Hillary Clinton fought over who can be most trusted to reverse the 25-year trend of economic and social inequality in the United States, who would most effectively tax the rich and shift some of the wealth to the middle class and poor. Imagine if they fought over whose health care plan would move the nation toward a single-payer system with no private insurance participation? Clinton: "I’ll cut the defense budget so fast that the military-industrial complex will think it’s 1976 all over again." Obama: "Yeah? Well, I’ll eliminate 90 percent of the nuclear arsenal, quit selling high-tech weapons to trouble spots around the world, and institute an excess-profits tax on any corporation that milks the taxpayer in a defense contract." Take that.

I have a friend who’s in the political consulting business; he works on big national campaigns and does high-level strategy for the Democratic Party. He’ll laugh when he reads this; when I say this kind of stuff, he shakes his head and says, "This is a conservative country."

But I don’t believe it.

Another political consultant, a guy who’s run some of the most important liberal campaigns in the state over the past couple of decades, stopped by our office a few weeks ago, and after he talked about an energy plan he’s pushing, I took him aside and asked one of my favorite questions:

How much money would it take — what kind of a campaign would you have to run, and for how long — to counter a quarter century of brilliant, effective right-wing propaganda and reconvince the American people to have faith in the public sector? What would we have to do to make people think — as they did during the ’30s, ’40s, ’50s, and ’60s — that government is part of the solution, not part of the problem? If some rich person put up a billion dollars, could you do it?

"It wouldn’t take that much," the guy said. But from the look on his face, I suspect he thought it would be close.

I used to blame the media for all of this, but I’ve been in the media for a very long time now, and I don’t think it’s that easy. Somewhere along the line the bad guys figured out that if they repeated their message often enough and funded their think tanks and promoted their political leaders, eventually they’d sell a scam of cosmic proportions to the electorate. We could tell our story too, if we thought it was important enough.

Setting standards

Toilet paper. First aid kits. Drinking water. These are just a few of the essential supplies one might expect to find in high-traffic facilities owned or paid for by the city that serve more than a thousand people per night.

But San Francisco’s homeless shelters, which have been around for about 25 years, have repeatedly fallen short of meeting basic standards or even living up to the policies outlined in their city contracts.

Since 2004, regularly scheduled and surprise spot checks conducted by the 13-member Shelter Monitoring Committee have turned up a range of deplorable and deteriorating conditions in regard to cleanliness, nutrition, and humane treatment of residents — from bloody shower curtains and broken toilet seats to clogged drains and kitchen counters cluttered with dirty dishes. A survey of health and hygiene conditions — from functional sinks to the posting of proper hand-washing techniques — found that only 6 of 19 facilities met basic requirements.

"The Shelter Monitoring Committee makes reports to the Rules Committee, and their reports about conditions in the shelters were very, very disturbing," Sup. Tom Ammiano told the Guardian.

To fix that, Ammiano and a cadre of city staff, homeless-rights advocates, and Shelter Monitoring Committee members are drafting legislation that would require shelters to meet basic standards of care, force compliance through $2,500 fines, and formalize a swifter complaint process.

The Health Services Agency last year had $69 million to spend on housing and the homeless, a portion of which funds nine year-round single adult shelters and four family shelters, as well as four resource centers where homeless people may not find a bed but should be able to access other services, like showers, laundry, phones, and the shelter reservation system.

The management of the facilities is contracted out by the HSA to different nonprofit organizations, including some well-known national groups like the St. Vincent de Paul Society and Episcopal Community Services. The Department of Public Health also handles two of the contracts.

Those contracts stipulate a number of policies, including providing clients with access to electricity for cell phone charging, a guaranteed eight hours of sleep per night, toiletries and feminine hygiene products, first aid supplies, and Spanish translations of printed materials; and a mandate to treat all clients with "dignity and respect."

That doesn’t always happen, and the monitoring committee isn’t the only watchdog saying so.

The Coalition on Homelessness has been fielding complaints from shelter residents for more than 20 years. A recent increase prompted it to investigate deeper. In May 2007 the group published Shelter Shock, a report based on surveys of 215 shelter residents. The findings: 55 percent of people reported some kind of physical, sexual, or verbal abuse. One-third had no access to information in their native language. Thirty-five percent had nothing to eat.

"The Mayor has actually pointed to these problems as reasons to close the shelters," the report states. "Responsible bodies — the Board of Supervisors and the HSA — have failed to take corrective action. There has been a silence around shelters, giving the impression that shelter residents have been forgotten by the administration and the public at large."

Mayor Gavin Newsom, in his Jan. 8 inaugural speech, identified chronic homelessness and panhandling as high priorities of his second term and promised he’d be "redesigning our city shelter system so that they are no longer just refuges of last resort but spaces where homeless San Franciscans can find job training, drug treatment, and encouragement they need to exit homelessness. We’re getting out of the shelter business." At no point did he mention implementing shelter health and safety standards.

James Leonard, a member of the Shelter Monitoring Committee who has spent the past 18 months homeless in San Francisco and San Diego, won’t stay in the shelters anymore. All of his possessions were stolen three times. He missed several job interviews because he couldn’t charge his cell phone. Frustrated, he hit the streets again. The Homeless Outreach Team found him, officially dubbed him "shelter challenged," and gave him a stabilization bed, which he hopes will eventually transition into a lease in a single-room-occupancy hotel.

He told us the lack of standards contributes to the problem of chronic homelessness because more people would stay in the shelters, off the street, if they were safe and treatment were consistent from facility to facility.

"People keep looking at what’s wrong with those homeless people and keep skipping over what’s wrong with those shelters and some of those staff members," he said. "It’s a system set up to fail unless it has standards."

The issues extend beyond each shelter’s four walls. It’s a matter of public health for all San Franciscans. "Even if the shelters exist for a minute, they have to be healthy and humane," said Dr. Deborah Borne, medical director of homeless programs at the HSA’s Tom Waddell Health Center. "Because if they aren’t, they’re a danger to themselves and to others."

She cited the example of sitting on a Muni bus beside someone whose bag may be carrying bedbugs. "Everyone in San Francisco is affected by the fact that we have health issues in the shelters."

Borne moved from New York to San Francisco about a year and a half ago. On her fourth day on the job at Tom Waddell, a resident died at Next Door, which houses about 250 people per night and is one of the city’s largest shelters. She said the death was not the fault of any specific department, agency, or person, but it could have been avoided if some basic health and hygiene practices were standard for shelter staff and residents.

She brought together several key people, secured $300,000 in funding through HSA director Trent Rhorer, and launched the Shelter Health Initiative, a pilot project that included some of the standards that are part of Ammiano’s legislation specifically targeting health and hygiene.

Next Door and Hamilton Family Center participated, were surveyed on needs, and received adequate supplies of things like soap, hand towels, sanitizer, and gloves. "Up to the date of the training, they still didn’t have available the basic equipment required to protect themselves," said Jill Jarvie, a public health nurse from Tom Waddell who ran the pilot program.

It’s not enough to have cases of rubber gloves and hand sanitizer. They have to be used, and used properly. "Something like a cold virus can stay alive for a couple of days," Jarvie said. Close conditions in shelters compound the risk. "When you’re working in a place that sees 300 people a day, how you wash your hands can really make a difference," she added.

Thorough hand-washing techniques and procedures for cleaning up bodily fluids taught to staff trickle down to residents, and so far, it’s working. According to Jarvie, Next Door has reported a decrease in illnesses. "It’s been exciting to see we can actually do this," she said. The price of the pilot was about $15,000, a cost that would fall over time through bulk purchasing of supplies and as training becomes more standardized. Soon public health officials will be launching another phase, focused on bedbugs and scabies.

An initial budget analyst’s report, based on information provided by the HSA, predicted a $6.2 million price tag to fully implement standards throughout the city’s shelter system. Many say it’s an overinflated estimate based on assumptions that need more vetting.

"We were all stunned by the budget analyst’s report," said Quintin Mecke, secretary of the Shelter Monitoring Committee and head of its subsidiary work group on the legislation. "When you look at some of the assumptions, they’re just not true." For example, the HSA interpreted security to mean staffing all the shelters with full-time guards, when other mitigations like locks and staff training could be implemented instead.

Mecke and the work group believe that although there will be hard costs associated with the legislation, many are onetime and others are simply the price of complying with what’s supposed to exist already. Ammiano’s aide Zach Tuller said, "We expect the cost to come in under half a million because HSA claims so many of the services are already being provided. We’re looking to prevent slippage."

Dave Curto, head of contract compliance for the HSA, said the department agreed with some of the legislation and was still talking through specifics. He confirmed that policies do exist and shelters are provided with training manuals to enforce them.

"I think they are happening," he said of the HSA policies. "That’s why we’re a little confused."

A list of those policies is included in the budget analyst’s report, which Mecke said sent a conflicting message. "It creates the impression that things in the shelter system are other than what we found," he told a recent meeting of the standard of care work group, which is redrafting some of the legislation in preparation for a February hearing of the Budget and Finance Committee. "We want to be very clear at the Board of Supervisors that they don’t come away with the impression that these things exist, because they don’t."

Ammiano said this is a necessary first step toward making the shelters more humane, at a time when many assume they already are.

"I think one of the most annoying things that I read was C.W. Nevius [in the San Francisco Chronicle] taking this rather orchestrated Disneyland tour with Trent Rhorer and saying how wonderful the shelters were and then blaming the homeless for not wanting to be in them," Ammiano said. "But obviously C.W. Nevius and Trent Rhorer have something to wipe their ass with."

Bring back the car tax

EDITORIAL Assemblymember Mark Leno has shared with us some numbers from the legislature’s budget office, and they’re pretty compelling. Of the $14.5 billion shortfall the governor says we’ll see in the next 18 months, a full $9.36 billion — 65 percent — comes from exactly one source. That’s Gov. Arnold Schwarzenegger’s political decision to get rid of the state’s motor vehicle license fee. He calls it the car tax.

It’s crazy: for years the people of California paid the fee, which used to be 2 percent of the car’s value, to register their cars. It’s not a perfect tax, but it’s not a terrible one — people with expensive cars pay more — and it brought in a huge amount of money. When Schwarzenegger ran for office he promised to get rid of it, and that’s one of the first things he did after he was elected — but he never explained how the state was going to cover the cost.

California hasn’t been overspending on education and parks. It hasn’t been wasting huge amounts of money on social services or sending too much to cities. The state was already living on a rather modest budget. And then along came the recession, the huge interest payments ($2 billion) on the governor’s recent bail-out bonds, and the elimination of the vehicle license fee, and suddenly, there’s a massive budget shortfall.

The legislature’s pretty hamstrung here: Leno and some others will try, and try mightily, to bring in some new money, but it takes two-thirds of the State Assembly and the State Senate to pass a budget, and the Republicans, who have sworn on Ronald Reagan’s grave never to raise taxes, control more than a third of each house. And everyone, even the liberal Democrats, agrees that if you take a poll, the vast majority of Californians will oppose reinstating the dreaded "car tax."

But if you asked the question right — "Would you pay $200 per year to save public education, parks, and health services in California?" — you might get a better answer. This needs to be a massive, statewide campaign and education program — because unless we can turn around sentiment on the vehicle license fee, the next few years are going to be very, very ugly

Newsom takes a trip…and all the credit

While Mayor Gavin Newsom was jetting off to Switzerland to play celebrity and attend his fourth World Economic Forum – where on Friday he’ll lead a panel discussion entitled “How Cities Are Aiming For Sustainable Growth” – smart growth activists here were working with Board of Supervisors President Aaron Peskin to actually create sustainable growth policies for San Francisco.
In fact, the legislation Peskin has introduced to limit the amount of parking that will be built with housing downtown (and to delink parking from the housing price, thereby lower housing costs for most and making drivers pay for their impacts) is the kind of thing that Newsom has blocked or ignored in the past.
But as Peskin noted in the Examiner article, this is a smart solution that should be embraced by both environmentalists and developers. That means, no doubt, that after Newsom watches others do the work and take the political hits for being bold, he’ll swoop in later to claim the program, just as he did with Sup. Tom Ammiano’s health care measure.
BTW, on Friday morning, Newsom will be taking part in the “World Class Health Care for World Class Cities,” led by London Mayor Ken Livingstone, who willingly meets for a monthly Question Time with his city’s legislature and has led the way in the traffic congestion pricing program that San Francisco will consider adopting this summer (and which Newsom recently got on board with after Sup. Jake McGoldrick and others did the heavy lifting over the last two years).

How to save the Housing Authority

OPINION After repeated media attention to the myriad problems at the San Francisco Housing Authority, Mayor Gavin Newsom asked the agency’s director, Gregg Fortner, to resign. An interim director, Mirian Saez, was appointed to fill his shoes until a national search is conducted to find a permanent replacement. The mayor has announced replacements for two of the seven commissioners; one of the new appointees, Dwayne Jones, is a senior Newsom staffer.

As an affordable-housing advocate who works with residents of public housing, I am overjoyed at the prospect of change at the agency. No matter who is chosen to be the new director, a few key changes should be seriously considered for the city’s largest low-income-housing provider. Here are some suggestions:

1. Appoint commissioners who get it and care. The mayor could have made sweeping changes after he asked the SFHA commissioners to submit letters of resignation. Instead, he used the opportunity to appoint someone who is on his payroll. As long as political connections continue to trump experience, understanding, and compassion, tenants will suffer. What about having a public process in which residents and the community can nominate candidates? How about sharing the power to appoint housing commissioners with the Board of Supervisors, as is done with some other city commissions?

2. Listen to the residents, damn it! While it is refreshing to see the mayor look for solutions to the rampant problems at the SFHA, a panel of national experts is hardly necessary. The best experts are right here. They are residents, and they are clamoring to have their voices heard. Conduct a local survey, have regular open meetings, encourage the formation of resident councils, work with service providers and community groups that reach out to residents, and allow for resident participation as much as possible.

3. Talk among yourselves. The same lessons we learned after Sept. 11 and Hurricane Katrina apply to this disaster as well. City agencies that serve public housing residents are often unaware of the major issues at public housing developments. The Departments of Building Inspections and Public Health, for instance, should be monitoring conditions and reporting to the mayor and the supervisors. The Mayor’s Office of Housing should be working closely with the Redevelopment Agency, the Office of Community Development, and the Human Service Agency as they plan for the demolition and rebuilding of distressed projects. City officials and agencies shouldn’t have to pull teeth to get basic information from the SFHA.

4. Tell Nancy Pelosi and her colleagues to fight like hell. Whoever leads the Housing Authority in the future will always have a defense against charges of not addressing poor conditions because Congress keeps hacking away at the Department of Housing and Urban Development budget. We have powerful congressional representation in San Francisco; let’s push harder.

5. Step up to the plate to provide local resources to improve public housing. As hard as we fight to leverage more federal funds, it is nearly certain that the SFHA will still be severely underfunded. We can no longer rely solely on federal funds to house our lowest-income residents. A commitment to creative and innovative local funding solutions must continue or we will see an increase in the exodus of African American families, which the mayor claims to be committed to curbing.

Measures A and B (Children’s Hospital bond)

NO


The history of this pair of ballot measures speaks to the reasons to oppose them: Children’s Hospital, a private outfit, hired signature gatherers and put Measure B — a special tax to fund a $300 million bond to help rebuild the hospital, which needs a seismic upgrade — on the ballot without even consulting the county supervisors. The supervisors then came back with a compromise plan, Measure A, which Children’s is now supporting — but none of the supervisors have endorsed.

We’re not big on using public bonds and tax money to rebuild a private hospital (especially when the county’s public health system has so many needs of its own). And none of this was very well thought out. Vote no; if there’s a good reason to rebuild Children’s Hospital, there needs to be a much better public process to fund it.

Measure E (Albany pool bonds)

YES


Measure E would authorize $10 million in bonds to rebuild the public pool at Albany High School. It also includes money for new classrooms. The Alameda Green Party thinks the pool should have solar heat and use alternatives to chlorine, and we agree — but that’s not reason enough to block a modest measure to improve a widely used facility. Vote yes.

Measure G (Oakland school tax)

YES


This is a parcel tax that would charge property owners in Oakland $195 per year, with the money going to the public schools. Yes, the Oakland schools are still controlled by a state administrator, who can ultimately decide where the money will go, and yes, parcel taxes aren’t perfect, but with school funding in the state as dire as it is, we support almost any sort of tax that helps education. And while parcel taxes allow big commercial landlords to pay the same rate as small homeowners, there is a low-income-resident exemption. Vote yes. 2

Fixing the cab problem

EDITORIAL Sups. Michela Alioto-Pier and Gerardo Sandoval are both proposing changes that would allow taxi companies to raise the fees they charge drivers to lease cabs. Alioto-Pier’s plan seems entirely wrongheaded, and Sandoval’s could use some work. But both proposals fail to address the much bigger issues facing the industry.

Most San Francisco cabdrivers are independent contractors: they pay the taxi companies a "gate," or lease fee, every shift, buy their own gas, and keep whatever’s left from the fares customers pay. The city regulates both the meters and the gates.

But over the past few years the meter rate — the amount the drivers actually collect — has been mostly flat, while gates have risen and the cost of gas has soared. So the drivers are being squeezed. And, of course, as contractors they have no health insurance.

That’s obviously bad for the drivers, but it’s bad for the city too: if driving a cab doesn’t pay a decent wage, the quality of the drivers is going to decline. The long-termers, who know the city and have plenty of experience behind the wheel, are going to leave, and more of the remaining drivers will be scrambling (often at the risk of accidents) to get from one stop to the next as fast as possible so they can squeeze in more fares per shift.

Alioto-Pier’s legislation as originally introduced would have allowed the big companies in town to raise gates by $18.50 per shift, from $91.50 to $110. That would have cost the average full-time driver almost $5,000 per year. Since most drivers aren’t making big money these days anyway, that sort of a pay cut would be brutal.

Alioto-Pier is now amending the bill, and it’s not clear how extensively she’ll change it, but even a small gate increase is unacceptable. Even if the cab companies need more money, they shouldn’t take it from the drivers; while tourists and some residents would complain about a fare increase, the Board of Supervisors should accept no plan that doesn’t at least ensure that the drivers come out even.

Sandoval wants to allow very modest gate hikes for companies that switch to clean-energy cabs, which is a fine idea but needs to go further. Many of the companies rely on big, gas-guzzling cars; even if those vehicles ran on natural gas, they’d still be wasting fossil fuels. If the city wants to fight taxi pollution, the board should require all new cab purchases to meet tough mileage standards and should provide incentives to get the aging clunkers out of the fleet. (Cars that use less gas would help the drivers save on costs too.)

But the real issue here is that drivers continue to get screwed by the big cab outfits, and the supervisors need to take that on directly. There should be no gate increase until there’s a driver health care plan in place — and in the future, all gate increases should be linked to fare hikes. If the companies get more money, the drivers should too; that’s only fair.

I’m interested! My interest in urinary stress incontinence goes way back to when I was first looking into the female ejaculation thing and telling people over and over that "this is not urinary stress incontinence! Nothing to do with that! Forget you ever heard the words urinary stress incontinence." Which I promptly did. And now I’m writing and teaching about what happens to sex after you have babies and barely have time to think about female ejaculation, but guess what’s back as an issue, big-time? Of course. People talk about baby weight and boobs and tiredness and getting "touched out" by having a baby stuck to you at all hours, but how often does anyone mention the fact that peeing when you laugh, sneeze, or do anything more interesting in the way of convulsive expulsions is (a) very common postpartum (in which postpartum can mean, say, 40 years postpartum) and (b) just mortifying and deeply antierotic? (Right, yes, except to that subset — you know who you are — who do find random uncontrollable peeing erotic; you can just sit down, since we’re not talking to you.)

Preliminary research suggests that stem cell therapy is a viable and efficacious treatment for stress urinary incontinence, according to results presented … at the 90th scientific assembly and annual meeting of the Radiological Society of North America.

"We believe we have developed a long-lasting and effective treatment that is especially promising because it is generated from the patient’s own body," said Ferdinand Frauscher, MD, associate professor of radiology at the Medical University of Innsbruck, Austria. In the study, women who had autologous adult stem cells implanted into the rhabdosphincter were free of incontinence for a year or longer, he said.

You caught the part where these were the women’s own stem cells, right? These are not the stem cells of controversy, drawn from the blasto-Americans whose lives are supposed to be every bit as valuable as that of an adult with a life and a family and a case of Parkinson’s or MS and no good therapies, nope. They were pulled out of the patients’ arms and injected back into the women’s urethras, where they proceeded to thicken the walls and make the sphincter more elastic and contractile. Plus, they’re smart:

"These are very intelligent cells," Dr. Frauscher said. "When they connect with other cells they stop growing." He said it takes about two weeks for the cells to complete the process. However, some women in the study reported a benefit within 24 hours of treatment. Dr. Frauscher said that was probably due to a "bulking" effect of the cells, creating pressure on the urethra.

In another, similar study, the women were still continent a year later. This is really good news, if a little early and a little techy and not likely to be appearing at a doc-in-the-box clinic near you any time soon. We can keep our fingers (and, unfortunately, our legs) crossed, though.

While we’re crossing, here’s more good news for women who, like me, did their dancing to ’80s music while the ’80s were still happening and might be wondering where their smooth skin, bouncing curls, and vaginal lubrication went: gone with the estrogen, of course. You could get whiplash keeping up with the latest on hormone-replacement therapy for menopause — it’ll give you cancer; no, it’ll protect you from heart attacks; no, it’ll give you heart attacks but protect you from cancer — but (also from Medscape, at www.medscape.com/viewarticle/568354):

The American Association of Clinical Endocrinologists (AACE) has released a statement on hormone replacement therapy (HRT) and cardiovascular risk, emphasizing that HRT does not appear harmful in younger women in early menopause and may indeed be beneficial in this group.

Younger for these purposes means under 60 (phew!) or less than 10 years after menopause. HRT isn’t going to be for everyone, and these are the same numbers (the Nurses’ Health Study) that have been crunched and crunched again while women get the above-mentioned sore necks (and sometimes much, much worse) in attempting to keep up with the latest, but right now this seems good. I’ve tried to look forward to my cronehood as a time of wisdom and serenity, but … bleah. Just whisper the words vaginal atrophy to any woman past 35 and you’ll see how eager most of us are to give up our estrogen. Given the choice, I’d rather pee my pants.

Life of the party

GREEN CITY Amid the much-hyped speculation about whom Democratic and Republican party voters will choose as their respective presidential nominees this year, California members of the Green Party will vote for their representative Feb. 5.

Candidates Jared Ball, Kent Hesplay, Jesse Johnson Jr., Cynthia McKinney, and Kat Swift met for their only planned debate Jan. 13 at Herbst Theatre in San Francisco, addressing a near-capacity crowd and laying out platforms that are decidedly more aggressive in tackling environmental and social problems than any proposed by the major-party candidates.

The candidates echoed one another on plans for immediate withdrawal from Iraq and shifting funding from the Pentagon into domestic programs for education, health care, and jobs. All professed grave concern about the environment, with Johnson calling the coal-mining method of mountaintop removal "ground zero for climate change."

By the end of the debate, Ball, a Baltimore hip-hop artist and professor in communications studies, fully endorsed McKinney, a former Democratic congressperson from Georgia. He emphasized that his greatest desire was for a strong national movement of people of all races, places, and income levels to continue what he called "incomplete revolutions" in the civil, labor, and women’s rights movements.

McKinney received the longest, most sustained standing ovation of the evening when she said, "Please unite the party. We can’t do it divided." She said the Greens represent the best hope of bringing together the large percentage of the country that’s spurned membership in both the Democratic and Republican parties. "I’ve never seen anything like I’ve seen in the Green Party," she said. "Please come together."

Also on hand — not participating in the debate but taking questions afterward — was Ralph Nader, a presidential candidate in 1996, 2000, and 2004, who hasn’t yet ruled out another run this year. Some Greens and other high-profile figures are urging him not to run and expressing concern that he’s become a polarizing figure who could hurt the party. Nader addressed the issue of party unity by saying, "I have very little to offer about how to unite the Green Party internally."

But he told the Guardian that if powerful institutional forces collude to limit his or the Green Party nominee’s access to the ballot, as he charges they did in 2004, he might run to highlight the need for greater political participation, saying, "I’ll be deciding within the next month." Nader has sued the Democratic Party, the John Kerry–John Edwards campaign, the Service Employees International Union, and a number of law firms and political action committees for allegedly conspiring to prevent him from running for president in 2004.

"Ballot access is a major civil liberties issue," Nader said. "Without voters’ rights, candidates’ rights don’t mean anything."

Yet the five announced candidates and Green Party activists on hand all seemed ready to rally around a new nominee for 2008, even as questions remain about whether the party should pool its energy and resources for national races or focus on state and municipal elections. Greens represent less than 3 percent of San Francisco’s registered voters and are outnumbered by Republicans four to one. Statewide, Greens amount to less than 1 percent. However, nearly 20 percent of California voters and 30 percent in San Francisco decline to state any party affiliation.

"I’m not sure yet that running a presidential candidate helps to grow the party, based on the experiences of the last several presidential attempts, especially in contrast to us focusing on races that can be won locally," Sup. Ross Mirkarimi, a Green who helped found the party in California, told the Guardian outside the debate. When asked if a national Green Party candidate trickles down attention and funding to the grassroots races, he said, "The theory is that it does. There isn’t any concrete evidence that it has coattails."

Since the Nader runs, Greens are wary of being tagged as presidential spoilers, but when that question was posed to this year’s prospects, they denied that it accurately portrays the voting landscape. As McKinney said, "When you’ve got a million black people who go to the polls … and nobody counts their votes … then don’t you dare call the Green Party spoilers."

President, Democrat

BARACK OBAMA


This is now essentially a two-person race for the Democratic nomination, and no matter how it comes down, it’s a historic moment: neither of the front-runners for the White House (and by any standard, the Democratic nominee starts off as the front-runner) is a white man. And frankly, the nation could do a lot worse than either President Hillary Clinton or President Barack Obama.

But on the issues, and because he’s a force for a new generation of political activism, our choice is Obama.

Obama’s life story is inspirational, and his speeches are the stuff of political legend. He can rouse a crowd and generate excitement like no presidential candidate has in many, many years. He has, almost single-handedly, caused thousands of young people to get involved for the first time in a major political campaign.

The cost of his soaring rhetoric is a disappointing lack of specific plans. It can be hard at times to tell exactly what Obama stands for, exactly how he plans to carry out his ambitious goals. His stump speeches are riddled with words like change and exhortations to a new approach to politics, but he doesn’t talk much, for example, about how to address the gap between the rich and the poor, or how to tackle urban crime and poverty, or whether Israel should stop building settlements in the occupied territories.

In fact, our biggest problem with Obama is that he talks as if all the nation needs to do is come together in some sort of grand coalition of Democrats and Republicans, of "blue states and red states." But some of us have no interest in making common cause with the religious right or Dick Cheney or Halliburton or Don Fisher. There are forces and interests in the United States that need to be opposed, defeated, consigned to the dustbin of history, and for all of Obama’s talk of unity, we worry that he lacks the interest in or ability to take on a tough, bloody fight against an entrenched political foe.

Still, when you look at his positions, he’s on the right track. He wants to raise the cap on earnings subject to Social Security payments (right now high earners don’t pay Social Security taxes on income over $97,000 a year). He wants to cut taxes for working-class families and pay for it by letting the George W. Bush tax cuts on the rich expire (that’s not enough, but it’s a start). He wants to double fuel-economy standards. His health care plan isn’t perfect, but it’s about the same as all the Democrats offer.

And he’s always been against the war.

It’s hard to overstate the importance of that. Obama spoke out against the invasion when even most Democrats were afraid to, so he has some credibility when he says he’s going to withdraw all troops within 16 months and establish no permanent US bases in Iraq.

Hillary Clinton has far more extensive experience than Obama (and people who say her years in the White House don’t count have no concept of the role she played in Bill Clinton’s administration). We are convinced that deep down she has liberal instincts. But that’s what’s so infuriating: since the day she won election to the US Senate, Clinton has been trianguutf8g, shaping her positions, especially on foreign policy, in an effort to put her close to the political center. At a time when she could have shown real courage — during the early votes on funding and authorizing the invasion of Iraq — she took the easy way out, siding with President Bush and refusing to be counted with the antiwar movement. She has refused to distance herself from such terrible Bill Clinton–era policies as welfare reform, the North American Free Trade Agreement, and don’t ask, don’t tell. We just can’t see her as the progressive choice.

We like John Edwards. We like his populist approach, his recognition that there are powerful interests running this country that won’t give up power without a fight, and his talk about poverty. In some ways (certainly in terms of campaign rhetoric) he’s the most progressive of the major candidates. It is, of course, a bit of a political act — he was, at best, a moderate Southern Democrat when he served in the Senate. But at least he’s raising issues nobody else is talking about, and we give him immense credit for that. And we’ve always liked Dennis Kucinich, who is the only person taking the right positions on almost all of the key issues.

But Edwards has slid pretty far out of the running at this point, and Kucinich is an afterthought. The choice Californians face is between Hillary Clinton and Barack Obama. And Obama, for all of his flaws, has fired up a real grassroots movement, has energized the electorate, and is offering the hope of a politics that looks forward, not back. On Feb. 5, vote for Barack Obama.

President, Republican

RON PAUL


We have a lot of disagreements with Ron Paul and his libertarian worldview. He opposes the taxes that we need to make civil society function and the government regulations that are essential to protecting the most powerless members of society. From its roots in the Magna Carta and Adam Smith’s economic theories to the Bill of Rights, it’s clear the United States was founded on a social compact that libertarians too often seem to deny. And Paul compounds these ills in the one area in which he departs from the libertarians: he doesn’t support federal abortion rights. He’s been associated with some statements that are racially insensitive (to say the least). He clearly shouldn’t be president.

But he won’t — Paul isn’t going to win the nomination. So it’s worthwhile endorsing him as a protest vote for two reasons. His presence on the ballot serves to show up some of the hypocrisies of the rest of the GOP field — and he is absolutely correct and insightful on one of the most important issues of the day: the war.

Paul is alone among the Republican candidates for president in sounding the alarm that our country is pursuing a dangerous, shortsighted, hypocritical, expensive, and ultimately doomed strategy of trying to dominate the world militarily. He opposed the invasion of Iraq and thinks the US should pull out immediately. It’s immensely valuable to have someone like that in the GOP debates, speaking to the conservative half of our country about why this policy violates the principles they claim to hold dear.

Paul is absolutely correct that if we stopped trying to police the world, ended the war on drugs, and quit negotiating trade deals that favor multinational corporations over American families and workers, we would be a far more free and prosperous nation.

President, Green

CYNTHIA MCKINNEY


We endorsed Ralph Nader for president in 2000, in large part as a protest vote against the neoconservative politics of the Bill Clinton administration (the North American Free Trade Agreement, the General Agreement on Tariffs and Trade, welfare "reform," etc.). And Nader’s Green Party campaign had a place (particularly in a state the Democrats were going to win anyway). We’ve never been among those who blame Nader for Al Gore’s loss — Gore earned plenty of blame himself. But four years later we, like a lot of Nader’s allies and supporters, urged him not to run — and he ignored those pleas. Now he may be seeking the Green Party nomination again. Nader hasn’t formally announced yet, but he’s talking about it — which means he still shows no interest in being accountable to anyone. It’s too bad he has to end his political life this way.

Fortunately, there are several other credible Green Party candidates. The best is Cynthia McKinney, the former Georgia congressional representative, who has switched from the Democratic to the Green Party and is seeking a spot on the top of the ticket. McKinney has her drawbacks, but we’ll endorse her.

The real question here is not who would make a better president (that’s not in the cards, of course) but who would do more to build the Green Party and promote the best course for a promising third party that still hasn’t developed much traction as a national force. We’ve been clear for years that the Greens should be working from the grass roots up: the party’s first priority should be electing school board members, community college board members, members of boards of supervisors and city councils. Over time, leaders like Mark Sanchez, Jane Kim, Matt Gonzalez, and Ross Mirkarimi can start competing for mayor’s offices and posts in the State Legislature and Congress. Running a presidential candidate only makes sense as part of a party-building operation. (That’s what Nader did in 2000, and for all the obvious reasons he’s incapable of doing it today.)

But the Greens insist on running candidates for president, so we might as well pick the best one.

McKinney has a lot to offer the Greens. She’s an experienced legislator who has won several tough elections and taken on a lot of tough issues. As an African American woman from the South, she can also broaden the party’s base. She was a solid progressive in Congress, where she was willing to speak out on issues that many of her colleagues ducked (she was, for example, one of the few members to push for an impeachment resolution).

McKinney has her downside — in recent years she’s been flirting with the loony side of the left, getting a bit close to some Sept. 11 conspiracy theories that hurt her credibility (although she’s also made some very good points about the attacks and the lack of a serious investigation into what happened). And some of her supporters have made alarmingly anti-Semitic statements (from which, to her credit, she has attempted to distance herself). But she has to come out now, strongly, to denounce those sorts of comments and show that she can build a real coalition.

With those (serious) reservations, we’ll give her the nod.

Proposition 91 (use of gas tax)

NO


Prop. 91 is essentially an effort to ensure that revenue from the state’s gas tax goes only to roads and highways. It’s a moot point anyway: Proposition 1A, which passed last year, did the same thing, and now even proponents of 91 are urging a No vote.

But we’re going to take this opportunity to reiterate our opposition to Prop. 1A, Prop. 91, and any other ridiculous effort to restrict the use of gasoline tax revenues.

It should be clear to everyone at this point that the widespread overuse of automobiles is having far bigger impacts on California than just wear and tear on the roads. Cars are the biggest single cause of global warming, and they kill and injure more Californians than guns do, causing enormous costs that are borne by all of us. Driving a car is expensive for society, and drivers ought to be paying some of those costs. That should mean extra gas taxes and a reinstatement of the vehicle license fee to previous levels (and extra surcharges for those who drive Hummers and other especially wasteful, dangerous vehicles). That money ought to go to the state General Fund so California doesn’t have to close state parks and slash spending on schools and social services, as Gov. Arnold Schwarzenegger is proposing.

Proposition 92 (community college funding)

YES


Prop. 92 is another example of how desperate California educators are and how utterly dysfunctional the state’s budget process has become.

The measure is complicated, but it amounts to a plan to guarantee community colleges more money — a total of about $300 million a year — and includes provisions to cut the cost of attending the two-year schools. Those are good things: community colleges serve a huge number of students — about 10 times as many as the University of California system — many of whom come from lower-income families who can’t afford even a small fee increase. And, of course, as the state budget has gotten tighter, community college fees have gone up in the past few years — and as a result, attendance has dropped.

Part of the way Prop. 92 cuts fees is by divorcing community college funding from K–12 funding — and that’s created some controversy among teachers. Current state law requires a set percentage of California spending (about 40 percent) to go to K–12 and community college education, but there’s no provision to give more money to the community colleges when enrollment at those institutions grows faster than K–12 enrollment.

Some teachers fear that Prop. 92 could lead to decreased funds for K–12, and that’s a real concern. In essence, this measure would add $300 million to the state budget, and it includes no specific funding source. This worries us. In theory, the legislature and the governor ought to agree that education funding matters and find the money by raising taxes; in practice, this could set up more competition for money between different (and entirely worthy) branches of the state’s public education system — not to mention other critical social services.

But many of the same concerns were voiced when Prop. 98 was on the ballot, and that measure probably saved public education in California. The progressives on the San Francisco Board of Education all support Prop. 92, and so do we. Vote yes.

Proposition 93 (term limits)

YES


This is pathetic, really. The term-limits law that voters passed in 1990 has been bad news, shifting more power to the governor and ensuring that the State Assembly and the State Senate will be filled with people who lack the experience and institutional history to fight the Sacramento lobbyists (who, of course, have no term limits). But the legislature isn’t a terribly popular institution, and the polls all show that it would be almost impossible to simply repeal term limits. So the legislature — led by State Assembly speaker Fabian Núñez, who really, really wants to keep his job — has proposed a modification instead.

Under the current law, a politician can serve six years — three terms — in the assembly and eight years — two terms — in the senate. Since most senators are former assembly members, that’s a total of 14 years any one person can serve in the legislature.

Prop. 93 would cut that to 12 years — but allow members to serve them in either house. So Núñez, who will be termed out this year, could serve six more years in the assembly (but would then be barred from running for the senate). Senators who never served in the assembly could stick around for three terms.

That’s fine. It’s a bit better than what we have now — it might bring more long-term focus to the legislature and eliminate some of the musical-chairs mess that’s brought us the Mark Leno versus Carole Migden bloodbath.

But it’s sad that the California State Legislature, once a model for the nation, has been so stymied by corruption that the voters don’t trust it and the best we can hope for is a modest improvement in a bad law. Vote yes.

Propositions 94, 95, 96, and 97 (Indian gambling compacts)

NO


We supported the original law that allowed Indian tribes to set up casinos, and we have no regrets: that was an issue of tribal sovereignty, and after all the United States has done to the tribes, it seemed unconscionable to deny one of the most impoverished populations in the state the right to make some money. Besides, we’re not opposed in principle to gambling.

But this is a shady deal, and voters should reject it.

Props. 94–97 would allow four tribes — all of which have become very, very wealthy through gambling — to dramatically expand the size of their casinos. The Pechanga, Morongo, Sycuan, and Agua Caliente tribes operate lucrative casinos in Southern California, spend a small fortune on lobbying, and convinced Gov. Arnold Schwarzenegger to give them permission to create some of the largest casinos in the nation. Opponents of this agreement have forced the issue onto the ballot.

The tribes say the deals will bring big money into the state coffers, and it’s true that more gambling equals more state revenue. But the effective tax rate on the slot machines (and this is all about slot machines, the cash engines of casinos) would be as little as 15 percent — chump change for a gambling operation. And none of the other tribes in the state, some of which are still desperate for money, would share in the bounty.

The big four tribes refuse to allow their workers to unionize. While we respect tribal sovereignty, the state still has the right to limit the size of casinos, and if the tribes want the right to make a lot more money, they ought to be willing to let their workers, not all of them Indians, share in some of the rewards. We’re talking billions of dollars a year in revenue here; paying a decent salary is hardly beyond the financial ability of these massive operations.

The governor cut this deal too fast and gave away too much. If the tribes want to expand their casinos, we’re open to allowing it — but the state, the workers, and the other tribes deserve a bigger share of the revenue. Vote no on 94-97.

Proposition A (neighborhood parks bond)

YES


This $185 million bond has the support of a broad coalition of local politicians and activists, Mayor Gavin Newsom, and every member of the Board of Supervisors. It would put a dent in the city’s serious backlog of deferred maintenance in the park system.

The measure would allocate $117.4 million for repairs and renovations of 12 neighborhood parks, selected according to their seismic and safety needs as well as their usage levels. It would also earmark $11.4 million to replace and repair freestanding restrooms, which, the Recreation and Park Department assures us, will be kept open seven days a week.

The bond also contains $33.5 million for projects on Port of San Francisco land, including a continuous walkway from Herons Head Park to Pier 43 and new open spaces at regular intervals along the eastern waterfront. While some argue that the Port should take care of its own property, it’s pretty broke — and there’s a growing recognition that the city’s waterfront is a treasure, that open space should be a key component of its future, and that it doesn’t really matter which city agency pays for it. In fact, this bond act would provide money to reclaim closed sections of the waterfront and create a Blue Greenway trail along seven miles of bay front.

One of the more questionable elements in this bond is the $8 million earmarked for construction and reconstruction of city playfields — which includes a partnership with a private foundation that wants to install artificial turf. There’s no question that the current fields are in bad repair and that users of artificial turf appreciate its all-weather durability. But some people worry about the environmental impact of the stuff, which is made from recycled tires, while others wonder if this bond will end up giving control of 7 percent of our parkland to the sons of Gap founder Don Fisher (their City Fields Foundation is the entity contributing matching funds for city-led turf conversions). Although the Rec and Park Department has identified 24 sites for such conversions, none can take place without the Board of Supervisors’ approval — and the supervisors and the Rec and Park Commission needs to make it clear that if neighbors don’t want the artificial turf, it won’t be forced on them.

Prop. A also earmarks $5 million for trail restoration and $5 million for an Opportunity Fund, from which all neighborhoods can leverage money for benches and toilets through in-kind contributions, sweat equity, and noncity funds.

And it includes $4 million for park forestry and $185,000 for audits.

With a 2007 independent analysis identifying $1.7 billion in maintenance requirements, this is little more than a start, and park advocates need to be looking for other, ongoing revenue sources. But we’ll happily endorse Prop. A.

Proposition B (deferred retirement for police officers)

YES


We’ve always taken the position that relying exclusively on police officers to improve public safety is as useless as simply throwing criminals behind bars — it’s only part of the solution and will never work as an answer all on its own.

But we’re also aware that the city is suffering a dramatic shortage of police officers; hundreds are expected to retire within a few short years, and those figures aren’t being met by an equal number of enrollees at the academy.

So we’re supporting Prop. B, even if it’s yet another mere stopgap measure the police union has dragged before voters, and even though the San Francisco Police Officers Association is often hostile to attempted law enforcement reforms and is never around when progressives need support for new revenue measures.

Prop. B would allow police officers who are at least 50 years of age and who have served for at least 25 years to continue working for three additional years with their regular pay and benefits while the pension checks they’d have otherwise received collect in a special account with an assured annual 4 percent interest rate.

The POA promises Prop. B will be cost neutral to taxpayers, and the city controller will review the program in three years to ensure that remains the case. Also at the end of three years, the Board of Supervisors, with a simple majority vote, could choose to end or extend it.

POA president Gary Delagnes added during an endorsement interview that department staffers in San Francisco who reach retirement age simply continue working in other police jurisdictions. If that’s the case, we might as well keep them here.

No other city employees are eligible for such a scheme, which strikes us as unfair. And frankly, one of the main reasons the city can’t hire police officers is the high cost of living in San Francisco — so if the POA is worried about recruitment, the group needs to support Sup. Chris Daly’s affordable-housing measure in November.

But we’ll endorse Prop. B.

Proposition C (Alcatraz Conversion Project)

NO


We understand why some people question why a decaying old prison continues to be a centerpiece of Bay Area tourism. A monument to a system that imprisoned people in cold, inhumane conditions doesn’t exactly mesh with San Francisco values.

But the Alcatraz Conversion Project, which proposes placing a half–golf ball–like Global Peace Center atop the Rock, is a wacky idea that looks and sounds like a yuppie tourist retreat and does little to address the island’s tortured past. People don’t have to support everything with peace in the title.

The proposal includes a white domed conference center for nonviolent conflict resolution, a statue of St. Francis, a labyrinth, a medicine wheel, and an array of what proponents call "architecturally advanced domed Artainment multimedia centers."

We agree with the ideal of dedicating the island to the Native Americans who fished and collected birds’ eggs from this once guano-covered rock for thousands of years and whose descendants carried out a bold occupation at the end of the 1960s. But this proposal seems based on wishful thinking, not fiscal or environmental realities.

The plan is backed by the Global Peace Foundation, which is a branch of the San Francisco Medical Research Foundation, a Mill Valley nonprofit founded by Marin resident and Light Party founder Da Vid. It’s just goofy. Vote no.

In 1996, Your Black Muslim Bakery lieutenant Nedir Bey had a wealth of ammunition with which to lobby city leaders for a $1.1 million loan to fund his health care company, E.M. Health Services.

The previous year, the city of Oakland had agreed to spend hundreds of millions of dollars to bring the Oakland Raiders back from Los Angeles, a deal that quickly soured and has cost the city and Alameda County taxpayers more than $20 million a year ever since.

The developers of a new downtown ice rink had defaulted on $11 million in bonds just three months after the facility opened.

The city had also given plenty of money to other businesses, most white-owned. As a result, the City Council was getting a relentless drubbing from bakery members and black business associates who lined up at meetings to speak on behalf of E.M. Health Services and its efforts to obtain the loan.

They argued that white business owners had an easier time obtaining credit, unsecured loans and support from the city while black-owned businesses endured undue scrutiny. Elected officials endured hints and outright accusations of racism if they dared ask questions about the company or collateral for the loan.

Some of those accusations occurred during the June 4, 1996, council meeting where the officials discussed giving E.M. Health an interim start up loan of $275,000 in city funds. The loan was needed because the company’s application for a $1.1 million share of federal Housing and Urban Development funds for job training programs had not yet been distributed to the city of Oakland.

During the meeting, Shannon Reeves, then-president of the NAACP Oakland chapter, accused the city’s black elected officials of forgetting where they came from.

“It’s time to deliver for the people in the community…,” Reeves said. “We need those who look like us to advocate for us.”

Beth Aaron, executive director of the Bay Area Black Contractors Association also testified at the meeting that night. She said the record proved that white-owned businesses had a much easier time getting Oakland to open its purse strings.

“Those who are white or friends of friends get things done very quickly,” she charged. “Those of us who are of color… do not.”

Even Nedir Bey got into the act.

“A few years ago we wouldn’t have been able to come here and ask for anything without getting run out,” he said. “Cut us a check on Friday for $275,000. Compare us to other projects that you have passed.”

A decade later, E.M. Health is just an unpaid debt on the city’s books, its license suspended by the California Franchise Tax Board. Principal payments first due in May 1998 never materialized, and by the time city staff knocked on its doors in October 1999, the offices had been cleared out.

But the story of how the business, a subsidiary of the now-bankrupt Your Black Muslim Bakery, received the money despite a flawed business plan and a disturbing criminal incident in Nedir Bey’s past illustrates the extent politics and pressure played in officials’ decision to approve the loan.

Bakery members have also been linked to several violent incidents, including the shooting death of journalist Chauncey Bailey, as well as alleged real estate and welfare fraud and child rape. ‘Intimidation factor’

“In reality it was political pressure that got them the loans,” said now-City Council President Ignacio De La Fuente, who was a councilmember at the time. “Deep down inside everybody knew it was bull—. No business plan, no records anyone could show. … And they kept saying they were failing because they didn’t get the city’s money soon enough.”

Retired councilmember Dick Spees, who is white, remembers how heated those meetings were, of being accused of racism because he dared question the business plan or ask about collateral or a missing business license. Bakery members would line up along the wall and refuse to sit, he recalled.

“It sounded good (on paper), this training program to help black people who were not getting opportunities,” Spees said recently. “But there was this intimidation factor, it just didn’t feel comfortable.”

Spees said he grew suspicious when Nedir Bey started racking up ineligible expenses even before federal government lenders had determined E.M. Health’s job training program met its criteria for financing.

Spees said he ended up voting for the loan and for several thousand dollars in advances from city coffers after he was assured by city staff on more than one occasion that HUD would approve the loan and that Bey had put up collateral.

De La Fuente, now council president, said he understood that the HUD money was intended for riskier loans, but that was no reason to cave in to pressure and give the money without trying to protect the city’s resources.

“I never got their support,” he said, referring to his black council colleagues, Nate Miley, Dezie Woods-Jones, Elihu Harris and Natalie Bayton.

Kidnap, torture

The city gave Nedir Bey money despite a disturbing incident that occurred on March 4, 1994, when Qiyamah Corporation, E.M. Health’s nonprofit parent company was still in its infancy.

On that date, Nedir Bey and Abaz Bey, another spiritually adopted son of bakery founder Yusuf Bey, were arrested and charged with abducting, assaulting, torturing and robbing a man they believed had cheated them on a real estate transaction.

Abaz Bey and other members of the bakery lived in an apartment building on 24th Street in North Oakland, the same one Nedir Bey wanted to buy with his very first request for city money, that ultimately was reduced in scope. The owner had hired the bakery to provide security after being sued by tenants fed up with rampant drug dealing and other crime.

According to police and court records, three men, led by Nedir Bey, beat the man with a flashlight and burned him with a hot knife. The arrests sparked a tense, full-scale standoff between more than 40 police officers and a similar number of male bakery members.

According to news reports, then-Mayor Elihu Harris agreed to meet the demand of bakery patriarch Yusuf Bey to discuss the standoff and the arrests.

Nedir Bey pleaded no contest to one felony count of false imprisonment. He was sentenced to three years’ probation after a veteran Oakland police officer and members of the community wrote a support letter on his behalf.

The probation report noted that two other prominent Oakland residents acted as character references for Nedir Bey: Alameda County Supervisor Keith Carson and Larry Reid, then aide to Mayor Harris. However, Reid, now an Oakland city councilmember, said he never wrote a letter or served as a reference for Nedir Bey.

When Tribune reporters Diana Williams and Paul Grabowicz questioned whether the the arrest should impact his loan application, Nedir Bey said such details were irrelevant.

“Nelson Mandela spent 27 years in prison, and he was respectable enough to become president of South Africa,” he was quoted as saying in a June 1996 Oakland Tribune article.

Unapologetic support

Alameda County Supervisor Nate Miley, who was an Oakland council member and pushed hard for the E.M. Health loan, said recently that he never knew about Nedir Bey’s felony conviction or other clashes between bakery members and the police.

“Then-police chief Richard Word and I chaired the Public Safety committee and I didn’t know about it,” Miley insisted. “Clearly, I had a sense that the police had some concerns (about bakery members), but not how it’s been depicted recently.”

Miley is unapologetic about his unflinching support of E.M. Health during his time on the council. He wasn’t overly concerned when the company defaulted, he told his colleagues at the time, because the federal money was intended to fund higher-risk ventures.

He recalled in a recent interview that African-Americans had good reason to believe black businesses weren’t getting a fair share of city contracts or loans. Oakland’s leaders had poured millions in public money into bringing the Raiders home from Los Angeles and bailing out the Ice Center, Miley said, and African-Americans never let them forget it.

It’s also possible that city staff and some council members were intimidated by the accusations of racism, he added.

“I think we were very sensitive (about accusations) of being racist and Uncle Toms,” said Miley, who is African American.

“When E.M. came in to get a loan … on the face of it that looked like very worthy cause, something that would serve the public. So we decided to give them a chance,” Miley said, adding that there was some concern over the money being used for a car and consultants.

“We gave them some technical assistance and guidance rather than pulling the rug out from under them completely,” Miley recalled. “Still, even if it’s federal money they got, it’s still public taxpayer dollars down the toilet.”

Miley said he admired Yusuf Bey and the way he preached self-reliance, spirituality and discipline. Oakland was suffering record homicides and here was someone who was reaching out to ex-cons or those who might otherwise get caught up in the cycle of violence and helping them turn their lives around and earn money legitimately for their families, Miley said.

In February 1996, a smiling, soft-spoken Nedir Bey stood before the City Council and told them as much.

“This is an excellent program and it will target men and women who are not working presently and have no job skills,” Bey said. “We can train them in the home health care field and start them on a better way of life.”

‘Brilliant’ concept

Redevelopment Agency Director Gregory Hunter said the company’s goals were hard to turn down even if E.M. Health’s promises lacked details.

“The concept was brilliant, absolutely brilliant,” he said, adding that the business proposal drew applause from as far away as Washington, D.C. “Unfortunately, the execution fell somewhat short of the expectations the city had.”

Elihu Harris, now the chancellor of Peralta Community College District, was reluctant to discuss the matter recently because he said he did not recall many details. Harris said his dad received home health care from employees of E.M. Health, but it was his mother who handled the contract.

He added that a community loan advisory committee _ a body the federal lenders required _ had voted to fund E.M. Health, and the council debated that recommendation back and forth for many months. He said the council was not provided with a lot of details about the company.

“The (loan committee)… had really done the research,” Harris said. “The council was between a rock and a hard place.

“(E.M. Health) had made some mistakes and they were going to try and rectify those mistakes,” Harris said. “There was a lot to be concerned about, but they had strong community support.”

One supporter who turned out early and often to lobby for Nedir Bey was Theodora Marzouk, an administrator for Oakland-based Community Care Services, Inc.

She testified more than once about the shortage of training programs for nurses’ aides and said her own company couldn’t supply enough of them. She urged Oakland’s leaders to fund E.M. Health.

But Marzouk ended up on E.M. Health’s payroll for the last two quarters of 1996 earning more than $20,000, city records show.

Marzouk refused to comment for this story, but she sounded surprised to hear that she’d once been listed as an employee.

In any case, by 2000, the company’s business license was suspended, and by 2003, Alameda County records show, state and federal tax officials during the intervening years had imposed tax liens on the company’s assets totalling nearly $200,000.

But today, E.M. Health’s motto “Big enough to serve, small enough to care” is little more than a failed promise.

E.M. Health Services, a home health care company founded by a high-ranking member of Your Black Muslim Bakery, opened for business in July 1996, flush with a $1.1 million loan from the city of Oakland.

But shortly over a year later, signs of trouble already plagued the business — and a review of documents shows that the founders of the struggling company paid themselves lavish salaries, and lucrative consulting contracts went to bakery associates and family members.

More than a decade later, the city hasn’t received one penny in repayment for the loan, and questions remain over why city officials granted the loan in the first place.

Under the terms of E.M.’s loan, the company wasn’t scheduled to make principal payments for two years — until 1998 — but just 15 months after getting the money, CEO Nedir Bey asked to defer repayments until 2000.

The city, which had already questioned several invoices submitted by the company, did not approve the extension. Instead, officials responded by requesting an audit of E.M.’s books.

In his request for an extension, Bey did not mention that in May 1997, E.M. Health had applied to the California Department of Insurance for a $2 million loan to purchase a 4,000-square-foot office building on 17th Street in downtown Oakland.

In his application to the state, Bey cited Oakland’s loan approval as proof of his good reputation, even though by then the city was already questioning tens of thousands of dollars in operating expenses claimed by his company.

The $1.1 million loan agreement called for E.M. Health to begin repaying monthly interest and principal payments of $19,692 on May 1, 1998, the date the company was projected to have enough billable clients to break even.

But May came and went with no payments.

And, documents show, E.M. Health would ask for more.

Bakery members also have been linked to several violent incidents, including the Aug. 2 shooting death of journalist Chauncey Bailey, as well as alleged real estate and welfare fraud and child rape.

Details of the company’s financial growth were outlined in correspondence between Nedir Bey and various city staff who reviewed documentation to support the original $1.1 million loan application, as well as documents surrounding Nedir Bey’s later attempts to obtain a $2.5 million loan that was never granted.

In a January 1997 letter to the city, E.M. Health said it had contracts with 13 patients between October and December 1996, which should have generated more than $23,000 in revenues for the three-month period.

The same letter said seven would-be home health aides had graduated from a training program run by a different company. Those aides could not be sent out to care for Medicare/MediCal patients until they passed their certification exams that month, the letter said.

The letter also reveals that E.M. Health had a goal of generating $1.2 million in income in 1997 by providing services to 50 clients. The company instead reported large losses in 1996 and 1997.

It started to pull in more revenue early the following year, according to a letter from former Economic Development Chief Bill Claggett addressed to then-City Manager Robert Bobb.

Clagget’s letter stated that the company had a net profit of $30,068 for the first two months of 1998, but was still experiencing delays in receiving reimbursements for its Medicare/MediCal clients.

By June 17, 1998, Nedir Bey stated in a letter to city loan department manager Teri Robinson-Green that E.M. was “doing about $80,000 a month.” In another letter listing E.M.’s achievements, Bey claimed the company had hired 55 people, trained 30 people and served more than 200 patients.

But still no loan payments.

E.M. Health’s agreement with the city stated that the company and its employees, many of whom were also trusted bakery associates and family members, would not profit from the business. Any extra income after expenses would be funneled back into Qiyamah, a nonprofit organization founded by the bakery to further Yusuf Bey’s community work. Qiyamah was E.M. Health’s parent company.

But the salaries, car lease and billing rates charged by bakery members who moonlighted as consultants to E.M. Health coupled with too few billable clients and delays in reimbursements by Medicare and MediCal all but ensured there wouldn’t be enough money left over to pay back the city’s loans.

“It’s interesting how that millionaire from the skating rink got $12 million and declared bankruptcy and never paid the city back,” Nedir Bey said, referring to the builders of Oakland’s downtown ice rink, who defaulted on an $11 million loan before E.M. Health Services was funded. The city took possession of the rink. “Is the city calling him and trying to ask him those kind of questions?

“The bottom line for me, I’m trying to move forward with my life. Everything that you’re discussing is in my past,” Bey said.

A popular message

E.M. Health’s business model resonated with Oakland’s black politicians who were eager to even the playing field for black businesses that had not gotten an equitable share of city contracts and loans. They lauded the accomplishments of Yusuf Bey — the controversial but charismatic founder of Your Black Muslim Bakery — and viewed the health care proposal as a continuation of his good works.

The plan also resonated with the U.S. Department of Housing and Urban Development and appeared to meet its criteria for loan funding. E.M. Health’s $1.1 million loan came from a $44 million pot of money the federal agency offered Oakland to fund start-up organizations that sought to provide jobs in low-income communities.

Still, in a June 4, 1996, letter to Kofi Bonner, Oakland’s then-director of community development, local HUD director Steven Sachs wrote that “E.M. Health Services business plan is still being developed …” with many “issues still to be worked out.”

Sachs urged the city to consider “providing a much smaller amount of financial assistance to this start-up business.”

That same night, despite Bonner’s warning that Nedir Bey had not yet provided several documents the city required for the loan, nor procured a provisional license from state health officials, the council voted to give the company a $275,000 advance on the $1.1 million HUD loan.

In fact, even though E.M. Health was $63,000 in arrears in its business taxes, the company ended up getting $538,000 in interim loans from the city of Oakland over the next six months, before HUD officials reimbursed Oakland for the money in April 1997.

Nedir Bey relied on that type of sentiment when he approached the city in February 1998 and asked for an additional $2.5 million — half loan, half grant — to buy a shopping center in West Oakland to house a new urgent care clinic, in addition to funds he sought unsuccessfully from the state department of insurance.

The shopping center plan lacked numerous financial details and included no downpayment or personal investment by Nedir Bey.

Nonetheless, he lined up his supporters and produced letters of recommendation from well-respected medical experts, including David Kears, director of the Health Care Services Agency for Alameda County; Michael Lenoir, president of the Ethnic Health Institute at Alta Bates/Summit Hospitals; and H. Geoffrey Watson, president of the Golden State Medical Association, which represents 2,000 African-American physicians in California.

Claggett said he would have loved to have someone revitalize that blighted shopping center, but nothing about E.M.’s finances by then suggested it could support a new business venture. City records show that E.M. Health incurred losses of $425,000 during 1996 and $343,000 in 1997.

E.M. Health was already three months behind on the payments for the $1.1 million loan, and a mere six months later, E.M. Health’s parent, the Qiyamah Corporation, would default on a

$100,000 bank loan originally signed by Saleem Ali Bey, also known as Darren Wright.

‘I don’t think they ever gave up’

Nedir Bey nonetheless again pressured the city into rushing the review of his new loan request. By July 1998, he sought direct backing from then-Mayor Elihu Harris, whose father was an E.M. Health patient for a short time, according to company records on file with the city.

“Staff should be more inform (sic) on the procedures and policies of the city of Oakland as opposed to me having to check with the mayor and then letting you know what you can and cannot do,” Bey said in a July 1998 letter to Gregory Hunter, now Oakland’s redevelopment agency director, apparently unhappy that the request had not yet been forwarded to the loan review committee.

Kears recalls Nedir Bey first approached him for a letter of recommendation, but that evolved into a request for money to finance outreach efforts for new patients. The county wound up giving Bey a $25,000 contract, the most it could provide without approval from the Alameda County Board of Supervisors. Kears said he doesn’t know whether E.M. Health ever submitted invoices to use any of the money.

The $2.5 million loan application eventually stalled as Nedir Bey failed to produce documentation requested by the city related to the first infusion of cash, the repayment of which was falling further and further behind.

By the time the city sent its first default letter to E.M. Health in December 1998, the payments were eight months past due and the company had crumbled.

City employees would later discover that the company’s offices had been cleaned out, office furnishings and computer equipment pledged as collateral gone.

Claggett said that not long afterward, he was questioned by the FBI about E.M. Health and Nedir Bey. The FBI’s San Francisco office did not return a call seeking comment about the probe.

No way to collect

The Oakland city attorney sued E.M. Health

in December 2000 in an attempt to recover $1.45million in loan funds and $98,600 in unpaid interest. The city won a default judgment, but no one could collect on it, in part because there was no personal guarantee made when the loan was awarded.

City Attorney John Russo said recently that it is up to the city’s Finance Department to collect on the $1.5 million judgment, which remains unpaid today.

The city wasn’t the only one left holding worthless paper when E.M. Health deteriorated. Orthopedic and Neurological Rehabilitation, Speech Pathology Inc. of Los Gatos sued Nedir Bey and Cecil R. Moody, an E.M. Health agent listed among business registration records, in 2000 to recover $8,700 worth of services it provided to the company’s patients over a two-month period. According to the lawsuit, E.M. Health billed MediCal and Medicare but never reimbursed the company.

In May, Daulet Bey, a Muslim wife of Yusuf Bey and mother of current bakery CEO Yusuf Bey IV, 21, and her daughter Jannah Bey filed papers to revive Qiyamah’s state business license. It’s not clear whether bakery associates plan to use Qiyamah to attempt a new business venture.

The license was promptly suspended again by the state Franchise Tax Board for failing to file an information report in 2005, according to spokeswoman Denise Azimi.

Nedir Bey’s costly experiment was finished and thousands in unaccounted for public funds were left in his wake.

How Oakland’s fearful politicos enabled waste: Part 1

Editor’s note: This is the first of a three-part series examining a $1million city loan to a Your Black Muslim Bakery affiliate that was never repaid.

It was a noble cause: Train welfare recipients as home health aides and put them to work caring for homebound sick and elderly clients.

A decade ago, while Your Black Muslim Bakery founder Yusuf Bey enjoyed unwavering support and adulation from black businesses and politicians, his spiritually adopted son, Nedir Bey, pressured and shamed city leaders into giving him a $1.1 million loan to help finance the promise of black entrepreneurial independence.

But the venture, E.M. Health Services, swiftly collapsed. The failure of CEO Nedir Bey to repay a dime of the loan made headlines at the time and prompted most to assume the company’s demise was caused by a combination of poor business decisions, bureaucratic hurdles and simple bad luck.

But was it?

City officials overlooked flaws in the company’s business plans and relented to black community leaders who insisted they award the loan, according to interviews, documents and other correspondence reviewed by the Chauncey Bailey Project.

The loan was granted to Nedir Bey despite his well-publicized arrest for the torture and kidnapping of a man two years earlier. Bey pleaded no contest to one felony count of false imprisonment and was sentenced to three years’ probation.

In awarding the loan to Nedir Bey, nearly every elected official lauded the accomplishments of Yusuf Bey in turning around the lives of troubled young men. Yet dozens of those men had armed themselves during a standoff with police two years earlier. And a few years later, Yusuf Bey himself would be accused of raping and fathering children with young girls who were placed in his care.

And the Chauncey Bailey Project has learned that in late 1999 and early 2000, the FBI investigated E.M. Health Services’ loan and Nedir Bey, although it’s not clear how the probe was resolved.

In the wake of reported real estate and welfare fraud allegedly committed by the wives and children of Yusuf Bey _ as well as the August arrest of a bakery member accused of the Aug. 2 shooting death of Bailey, the editor of the Oakland Post _ a deeper review of the E.M. Health Services loan reveals several questionable expenses that suggest an internal pattern of cronyism that enriched nearly every facet of the bakery empire’s inner circle including:

-Tens of thousands of dollars in consulting fees paid to companies controlled by Nedir Bey and his wife, Rosemarie Boothe-Bey, as well as other bakery insiders.

-Thousands of dollars in security fees paid to yet another company controlled by Your Black Muslim Bakery and thousands more in advertising fees paid to Universal Distributors, a company operated by associates of the bakery.

-$20,000 paid to the administrator of an Oakland home health company who had urged the city to award the loan to E.M. Health Services.

-Top-end salaries paid to Nedir Bey and his wife, Rosemarie Boothe, as well as to two of the Muslim wives of bakery patriarch Yusuf Bey who are accused of receiving fraudulent welfare payments at the time, and a second woman with whom Nedir Bey fathered children. Other bakery insiders filled the company’s payroll.

-15-day loans made to E.M. Health by Nedir Bey and other bakery associates that were repaid with hefty loan fees.

The beginnings

On April 30, 1996, the Oakland City Council awarded E.M. Health conditional approval for a $1.1million federal loan to establish a training program for home health aides.

According to loan documents and internal memos, the city approved that loan despite flaws in the company’s business plan and no discernible collateral or equity to back up the debt.

The money was part of a $44 million pot — half loan, half grant — awarded to the city by the federal Department of Housing and Urban Development to fund start-up ventures or help expand existing businesses in three distressed areas of Oakland with high unemployment rates. The federal money was supposed to create jobs, and it was intended for borrowers who could not qualify for conventional loans.

E.M. Health’s share of that pot — through the leadership of then-bakery lieutenant Nedir Bey — would further Yusuf Bey’s efforts to empower poor black residents and ex-cons by giving them training and job opportunities at various bakery outlets and private security companies affiliated with the patriarch’s expanding empire.

The loan proceeds were supposed to be used for start-up costs to recruit workers and patients, establish the home health training program and provide ongoing operating expenses.

The company never lived up to its promise. Ten years have passed and still not a cent has been repaid. The equipment pledged to secure the proceeds never surfaced. The promised jobs for low-income residents, as well as the promised services for sick and elderly clients, evaporated. The Oakland city attorney sued to recoup the debt, plus interest, but the city’s finance department has not been able to collect.

Nedir Bey, whose last listed occupation is business development consultant, would not answer questions about the business operations or why the company failed to take hold, saying that was “in the past.” In a brief telephone conversation, Bey said there were other Oakland businesses that defaulted on city loans and he asked if they were receiving the same level of scrutiny. Bey remains in Oakland but says he is no longer affiliated with the bakery.

Former bakery associate and businessman Ali Saleem Bey has spent the last several months trying to save the heavily indebted bakery enterprise from liquidation. Saleem Bey said he hasn’t spoken to Nedir Bey in years, but he defended E.M. Health’s efforts to provide job training and services to poor Oakland residents.

Saleem Bey, reached by phone, said the city subjected the business to undue scrutiny compared with others seeking public money. That scrutiny also led to the company being underfunded, Saleem Bey said, and contributed to its demise.

“We really felt we were sabotaged by the city, …” said Saleem Bey, who worked alongside other bakery associates to help launch the business.

“Politically, they never wanted to give us the money … and when it came time to work with us and make it go, they made it as hard as possible,” Saleem Bey said. “They wanted to wag their fingers at us.”

But the only thing that remains today from the ashes of E.M. Health is a considerable outstanding debt to taxpayers — a debt that could have been much larger.

Big plans, big loan requests

The Qiyamah Corp., E.M. Health’s nonprofit parent company, first filed state business registration papers in October 1993. The nonprofit organization was formed to expand the bakery’s community work and job training programs, and it wasn’t long before bakery members sought the city’s help in financing a new home health care venture.

Nedir Bey originally approached the city in approximately 1994 for a $3.4million loan to buy an apartment building on 24th Street in North Oakland. That would be used, he said at the time, as a base for his home health care program.

The building purchase didn’t qualify for HUD funds, and over time it was dropped from the plan. The loan request was whittled down to the $1.1 million, which was conditionally awarded to Qiyamah’s for-profit subsidiary, E.M. Health.

The company promised to create 32 full-time jobs, more than half of which would be filled by residents of West Oakland, East Oakland or San Antonio/Fruitvale — the three economically depressed areas targeted by HUD.

The company also promised to train 120 low-income residents and welfare recipients as home health workers, who would in turn provide services to Medicare and MediCal patients and other clients who were privately insured. According to E.M. Health’s business plan accepted by the city, insurance reimbursements would be more than sufficient to repay the loan. It might have worked if Nedir Bey had started small.

Instead, he purchased expensive office furniture and loaded the payroll with bakery insiders, most of whom had no health care experience, while spending little initially on actual medical supplies, according to loan documents.

Bill Claggett, the former director of Oakland’s Community and Economic Development Agency who inherited the E.M. loan in late 1997, said he couldn’t believe the city gave the company “a dime,” let alone $1.1 million.

“They didn’t know what they were doing,” Claggett said. “The cost per person served was much higher than any other similar business. It was clear (Bey) didn’t have the kind of staffing he needed for that operation.”

E.M. Health opened its doors on July 10, 1996, in an office storefront on Grand Avenue. That first year’s tax return posted income of $6,007 and a loss of $437,802. It spent $85,886 on consultants, $10,600 on security and only $5,708 for medical supplies. It survived almost exclusively on the city loan.

The list of employees included Nedir Bey’s wife, Rosemarie Boothe; and another woman, Kathy Leviege, with whom he has two children; family associate Janet Bey; and Madeeah Bey and Farieda Bey, two wives of bakery patriarch Yusuf Bey who are alleged to have received illegal welfare payments at the time, according to civil depositions taken recently in an unrelated case.

Within three months of receiving start-up funds from the city, Nedir Bey was on track to earn $108,000 a year, a figure that was out of line with what similar agencies in the Bay Area paid their CEOs, according to a spring 1997 memo in the city’s loan files.

Quarterly wage reports filed with the state show that Nedir Bey’s wife earned $47,000 as the assistant administrator, and Yusuf Bey’s wives — whose occupations were listed as marketing director and LVN/outreach coordinator — earned nearly $60,000 each, the same as Janet Bey, a registered public health nurse. Other than Janet Bey, none of the women had nursing degrees or related licenses, according to a review of state documents. Saleem Bey said it should not seem suspicious that members of the bakery’s extended family ended up on E.M. Health’s payroll. He said they worked many different jobs to help support the bakery empire and to further Yusuf Bey’s edict to be self-reliant.

He said they also worked alongside Nedir Bey to try and make the enterprise a success. To infer otherwise would be a mistake.

“It behooved the organization to be successful, so it wasn’t as if everybody was just eyeing this money and they wanted to steal a million,” Saleem Bey said. “If the business plan was successful, by this time it would have created 10 times that amount of money and created many jobs.”

Even so, the city’s loan staff requested that the compensation for E.M.’s three top executives be reduced by 20 percent, a move Nedir Bey protested in a memo to city officials.

Other questionable expenses

There were other missteps and invoices that city officials questioned before the city received the HUD proceeds, including a lease on a Cadillac and reimbursements to a security company controlled by the bakery.

One city staffer flagged the vehicle lease, $64,000 in consulting contracts, and thousands budgeted for security as ineligible uses of the federal funds. “Staff is exploring options for recovering these costs,” reads one memo from April 1, 1997.

That same year, in addition to their salaries, E.M. Health paid approximately $40,000 in consulting fees and service payments to Nedir Bey and relatives either directly or through companies that he and other associates of the bakery controlled, according to records on file with the city of Oakland.

Bakery associates also made 15-day loans to E.M. Health to cover operating expenses and charged substantial interest fees in return. Nedir Bey earned a $750 fee for a $9,000 loan he made to the company, and Ali Saleem Bey charged $1,000 interest for a $13,750 loan. Time after time, city staff questioned the invoices E.M. Health submitted for reimbursement, asking for more details or supporting documentation. But the money was never withheld for long.

A three-judge panel of the Ninth Circuit Court of Appeals has ruled that San Francisco employers must support the city’s new universal health care plan after all, setting aside enforcement of a judge’s ruling that the mandate violated federal law, noting that the city has a strong likelihood of winning its appeal of the lawsuit challenging the plan brought by the Golden Gate Restaurant Association. That’s great news for the city and residents who don’t have health insurance, and one more indication that the Ninth Circuit is still a holdout against the federal courts’ shift to the right. The appeal will be heard this spring on an expedited schedule.

Rebel women

LA GARRUCHA CHIAPAS (Jan. 8th) – Dozens of Zapatista companeras, many of them Tzeltal Maya from the Chiapas lowlands decked out in rainbow-hued ribbons and ruffles, their dark eyes framed by pasamontanas and paliacates that masked their personas, emerged from the rustic auditorium to the applause of hundreds of international feminists gathered outside at the conclusion of the opening session of an all-women’s Encuentro hosted by the Zapatista Army of National Liberation (EZLN) here at year’s end.

The Tzeltaleras’ line of march, which resembled a colorful if bizarre fashion parade, seemed an auspicious start to the rebels’ third “encounter” this year between “the peoples of the world” and the Zapatista communities and comandantes – an anti-globalization conclave last December and an Encuentro in defense of indigenous land this summer preceded the womens’ gathering.

Although the call for the event was issued under the pen of the EZLN’s quixotic spokesperson Subcomandante Marcos, the author of a recently published erotic coffee table book in which his penis plays the role of a masked guerrillero, the impetus for the women’s Encuentro sprung from the loins of the Zapatista companeras.

Last July, at the conclusion of a meeting with farmers from a dozen counties in the hamlet with the haunting name of La Realidad (“The Reality”), a young rebel from that community, “Evarilda,” apparently without clearing the invitation with the EZLN’s General Command, called for the all-womens’ encounter, explaining that men were invited to help with the logistics but would be asked to stay home and mind the children and the farm animals while the women plotted against capitalism.

True to Evarilda’s word, at the December 29th-31st gathering, which drew 300-500 non-Mexican mostly women activists to this village, officially the autonomous municipality of Francisco Gomez, and which honored the memory of the late Comandanta Ramona (d. January 2006), men took a decidedly secondary role. Signs posted around the Caracol called “Resistance Until the New Dawn,” a sort of Zapatista cultural/political center, advised the companeros that they could not act as “spokespersons, translators, or representatives in the plenary sessions.” Instead, their activities should be confined “to preparing and serving food, washing dishes, sweeping, cleaning out the latrines, fetching firewood, and minding the children.”

Indeed, some young Zapatista men donned aprons imprinted with legends like “tomato” and “EZLN” to work in the kitchens. Meanwhile, older men sat quietly on wooden benches outside of the auditorium, sometimes signaling amongst themselves when a companera made a strong point or smiling in pride after a daughter or wife or sister or mother spoke their histories to the assembly.

The role of women within the Zapatista structure has been crucial since the rebellion’s gestation. When the founders of the EZLN, radicals from northern Mexican cities, first arrived in the Tzeltal-Tojolabal lowlands or Canadas of southeastern Chiapas, women were still being sold by their families as chattel in marriage. Often, they were kept monolingual by the husbands as a means of control, turned into baby factories, and had little standing in the community. Those from the outside offered independence and invited the young women to the training camps in the mountain where they would learn to wield a weapon and use a smattering of Spanish and become a part of the EZLN’s fighting force. Fourteen years ago, on January 1st 1994, when the Zapatistas seized the cities of San Cristobal and Ocosingo and five other county seats, women comprised a third of the rebel army. Women fighters were martyred in the bloody battle for Ocosingo.

Key to bringing the companeras to the rebel cause was “The Revolutionary Law of Women,” officially promulgated that first January 1st from the balcony of the San Cristobal city hall, which decreed that women should have control over their own lives and their bodies. The law, which had been carried into the Indian communities by Comandantas Susana and Ramona, often meeting with hostility from the companeros, was “our toughest battle” Marcos would later note.

Integrating women into the military structure, which was not tied to local community, proved easier than cultivating participation in the civil structure, which was rooted in the life of the villages. Although women occupied five seats on the 19-member Clandestine Revolutionary Indigenous Committee (CCRI), the EZLN’s General Command, their numbers fell far shorter in 29 autonomous municipal councils and the five Juntas de Buen Gobierno (“Good Government Committees”) which administrate Zapatista regional autonomy.

But as the Zapatista social infrastructure grew, women became health and education promoters and leaders in the commissions that planned these campaigns and their profile has improved in the JBGs and autonomias.

Women’s Lib a la Zapatista has been boosted by the rebels’ prohibitions against the consumption of alcohol in their communities. Whereas many inland Maya towns like San Juan Chamula are saturated in alcohol, with soaring rates of spousal and child abuse, the Zapatista zone has the lowest abuse indicators in the state, according to numbers offered by the womens’ commission of the Chiapas state congress. As a state, Chiapas has one of the highest numbers of feminicides in the Mexican union – 1456 women were murdered here between 1993 and 2004, more than doubling Chihuahua (604) in which the notorious muertas of Ciudad Juarez are recorded. The low incidence of violence against women in the zone of Zapatista influence is more remarkable because much of the lowland rebel territory straddles the Guatemalan border, a country where 500 women are murdered each year.

With the men tending the kids and cleaning latrines, the women told their stories in the plenaries. Many of the younger companeras like Evarilda had grown up in the rebellion – which is now in its 24th year (14 on public display) – and spoke of learning to read and write in rebel schools and of their work as social promoters or as teachers or as farmers and mothers. Zapatista grandmothers told of the first years of the rebellion and veteran comandantas like Susana, who spoke movingly of her longtime companera Ramona, “the smallest of the small,” recalled how in the war, the men and the women learned to share housekeeping tasks like cooking and washing clothes.

“Many of the companeros still do not want to understand our demands,” Comandanta Sandra admonished, “but we cannot struggle against the mal gobierno without them.”

The Zapatista companeras’ struggle for inclusion and parity with their male counterparts grates against separatist politics that some militant first-world feminists who journeyed to the jungle espouse. Lesbian couples and collectives seemed a substantial faction in the first-world feminist delegations. Although no Zapatista women has publicly come out, the EZLN has been zealous in its inclusion of lesbians and gays and incorporate their struggles in the rainbow of marginalized constitutuencies with whose cause they align themselves.

Sadly, the Encuentro of the Women of the World with the Zapatista Women did not provoke much formal interchange between the rebel companeras and first-world feminists – who were limited to five-minute presentations on the final day of the event. Nonetheless, a surprise Zapatista womens’ theater piece did imply a critique: in the skit, a planeload of first-world feminists with funny hair (played by the companeras) lands in the jungle to deliver the poor Indian women from oppression.

Among international delegations in attendance were women representatives from agrarian movements as far removed from Chiapas as Brazil and Senegal, organized by Via Campesina, an alliance that represents millions of poor farmers in the third world, and a group of militant women from Venice, Italy who have been battling expansion of a U.S. military base in that historic city. Political prisoners were represented by Trinidad Ramirez, partner of imprisoned Ignacio del Valle (who is serving a 67-year sentence), leader of the farmers of Atenco. A message from “Colonel Aurora” (Gloria Arenas), a jailed leader of the Popular Army of the Insurgent People (ERPI), who now supports the EZLN, was read. Although he reputedly lives only a few villages away, Subcomandante Marcos (or his penis) did not put in an appearance at the women’s gathering.

Ladling out chicken soup at her makeshift food stand, Dona Laura told La Jornada chronicler Hermann Bellinghausen that once the womens Encuentro had concluded, everything would return to normal – “only normal would be different now.”

Although the Encounter amply demonstrated the increasing empowerment of the Zapatista companeras, how much of what was said actually rubbed off on those who came from the outside is open to question. “I didn’t really get a lot of it,” confided one young non-Spanish-speaking activist on her way home to northern California to report back on the women’s gathering to her Zapatista solidarity group.

Be that as it may, the EZLN is going to need all the women – and men – it can muster in the months to come. 2008 looms as a difficult year for the rebels with the mal gobierno threatening to distribute lands the Zapatistas recovered in 1994 to rival Indian farmer organizations and paramilitary activity on the uptick.

As has always been the case since this unique rebellion germinated, the Zapatistas turn the corner into another year in struggle.
