A complex and controversial project that would involve five San Francisco hospitals — including building a huge showcase facility for the wealthy atop Cathedral Hill — has prompted a debate about what average city residents need from the health care system.

California Pacific Medical Center, an affiliate of Sutter Health, proposes to downsize St. Luke’s Hospital, which primarily serves a low-income population in the Mission District, as part of a $2.5 billion proposal to renovate and retrofit three existing medical campuses, close another one, and build housing and a megahospital on Cathedral Hill that would draw patients from around the country.

CPMC’s grandiose plan was being considered strictly as a land use decision, despite its far-reaching impact on the city’s health care system. So Sup. David Campos created legislation calling for the city to create a citywide health services master plan and to use that as another tool for gauging future medical projects.

Debate over that legislation left some activists on both sides unhappy, with progressives disappointed that it won’t be able to stop a CPMC project they see as neglectful of the poor, and moderates wary of creating a new way to challenge development projects in the face of widespread unemployment in the construction industry.

But it struck a fine enough balance to win 8-3 approval by the board Nov. 16, enough to override a threatened mayoral veto. “I’m really happy and excited about the passage of this legislation,” Campos told the Guardian after the vote.

The legislation has a two-part mandate, with the first part kicking in as soon as it has final approval. It requires the Planning Department, with input from the Department of Public Health, to prepare a health care services master plan to identify current and projected needs for health care services and where they should be provided.

The second part, which begins in 2013, requires Planning to determine whether medical projects are consistent with the findings of this plan. That delay is credited to a last-minute amendment Campos granted during a Nov. 15 committee hearing after the hospital industry complained that the process could jeopardize its ability to meet state-mandated seismic retrofitting deadlines for projects already in the planning pipeline.

The passage of Campos’ legislation comes eight months after President Barack Obama signed the Patient Protection and Affordable Care Act. Hailed by its supporters as the most significant change to the U.S. health care delivery systems in 40 years, the reform package has also been greeted with criticism on both ends of the political spectrum. Progressives complain that it relies too heavily on private insurance companies and medical providers, while Tea Party supporters says that it’s government run amok and they have vowed to “kill the bill.” Senate Minority Leader Mitch McConnell (R-Ky) recently compared so-called Obamacare to “tyranny” in a speech to conservative legal scholars.

But here in San Francisco, the debate over Campos’ legislation — as heated and divisive as it was at times — yielded a surprising amount of consensus around the long-neglected idea that government should play a role in health care planning.

 

PULLING THE PLUG

The passage of Campos’ legislation marks the first time in 30 years that a government entity has mandated health care services planning in California. That approach West Bay Health Systems Agency, whose creation he opposed as governor of California.

Lucy Johns, a San Francisco-based health care planning consultant who wrote the only health care services master plan California has ever had, recalls what happened in the mid-1970s after President Gerald Ford signed legislation that established health system agencies nationwide.

“California established 14 health systems agencies, including the West Bay Health System Agency, which governed the nine Bay Area counties,” Johns told the Guardian. “The legislation mandated that they be established by every state, with the federal government providing the funding. So every state had to decide how many, how big, and how structured the health system agencies would be.”

Johns notes that state legislators were constrained when it came to the decisions these health service agencies made. “The governing bodies of the health systems agencies had to have a membership that was 51 percent consumer and 49 percent healthcare provider, which included doctors, nurses, and hospital administrators,” she said.

That history served as a backdrop for discussion of the Campos legislation, with the Planning Department staff report noting, “With the elimination of the West Bay Health Systems Agency in 1981, there is no longer a routine or comprehensive analysis of health service resources, needs, trends, and local impacts conducted for changes to or within medical uses.”

“It’s truly a historic moment for San Francisco,” Campos said after his legislation passed its Nov. 16 first reading (the second and final reading is set for Nov. 23, after Guardian press time). “We are the first city in the country to make sure land use decisions are aligned to our health care needs. That’s an unprecedented step that will shape the future of healthcare planning for years to come.”

Campos acknowledged that the passage of Obama’s heath reform package — which includes a mandate to purchase private health insurance beginning in 2014 — was also a catalyst for his legislation, along with the CPMC project.

“But it had more to do with seeing that the city didn’t have the tools it needed to evaluate projects in terms of whether they met the city’s healthcare needs and how they might impact people’s access to healthcare,” Campos said. “The main catalyst came from the community, which felt it was being asked to make decisions that will have long-lasting health care implications, but didn’t have any way to understand those needs. Those concerns were compounded by changes at the national level — and the recognition that these changes offer us an opportunity to engage in planning.”

Campos’ legislative victory came two months after members of the Cathedral Hill Neighbors Association joined nurses, medical workers, patients, and community groups in voicing concerns at a Sept. 23 public hearing about the draft environmental impact report for CPMC’s Cathedral Hill hospital and the other facilities that are part of its proposal.

These groups collectively expressed fear that downsizing St. Luke’s, closing the CPMC California campus, and transforming CPMC Pacific campus to an outpatient-only hospital will force low-income people to travel farther to access health care services while offering better service to the wealthy at Cathedral Hill. And neighbors worried that the proposed complex would increase traffic and require the demolition of rent-controlled apartments.

Formed in 1991 through the merger of Pacific-Presbyterian Medical Center and Children’s Hospital of San Francisco, CPMC has been affiliated with Sutter Health since 1996 and currently has four medical campuses in San Francisco: Pacific in Pacific Heights, California in Presidio Heights, Davies in the Duboce Triangle, and St. Luke’s in the Mission.

But CPMC’s longtime goal was to build a facility intended to be like the Mayo Clinic of the West Coast, a 15-story, 555-bed full-service hospital and specialty care facility at the corner of Van Ness Avenue and Geary Boulevard. Company officials have made approval for that project conditional on keeping St. Luke’s open in the face of the state’s deadline on seismic safety standards that the hospital doesn’t now meet.

“St. Luke’s Hospital was the big issue that got our attention,” Le Tim Ly, lead organizer for the Chinese Progressive Association, told the Guardian. His group has worked with residents in the city’s southeast sector around environmental justice, air quality, and pollution issues when they became aware of the threat to St. Luke’s. “All this, coupled with efforts to downsize Luke’s, left us alarmed by the disproportionate impact on an already impacted area.”

But alarm over CPMC’s plans has now revived the idea of healthcare planning.

 

MAKING A PLAN

As recently as the beginning of November, representatives for the Hospital Council of Northern and Central California — whose members include CPMC, Chinese Hospital, Jewish Home, Kaiser Permanente, Laguna Honda, St Luke’s, St. Mary’s, San Francisco General Hospital, and Veterans Affairs Medical Center — seemed opposed to any change in the way healthcare planning is done in San Francisco.

At a Nov. 1 hearing on the Campos legislation at the board’s Land Use and Economic Development Committee, Ron Smith, the Hospital Council’s senior vice president for advocacy, said his organization favored maintaining the city’s current procedures. “We would like to propose that the Health Commission does the planning, the Planning Commission does the land use, and that there is a required determination process which is in the current legislation,” Smith said. “We’re proposing that that continue.”

But two weeks later, after Campos amended his legislation so projects now in the planning pipeline are exempt from having to comply with the city’s health care services master plan, some members of the Hospital Council seemed to have a change of heart.

CPMC’s Chief Executive Officer Warren Browner surprised just about everybody when he publicly stated in mid-November that CPMC supports health care planning. “We strongly support the efforts of the city — we are in favor of health planning,” Browner said at a Nov. 15 hearing on the legislation.

“That statement was extraordinary,” said Lucy Johns, recalling CPMC’s history of resisting government control. “The conversation about this legislation has already changed the discourse, at least in public.”

Linda Schumacher, chief executive officer of Chinese Hospital, a community-owned, not-for-profit facility, explained at the same hearing that her organization had been concerned that Campos’ legislation would affect her hospital’s ability to move ahead with a $150 million project that has been in the pipeline since 2003.

“We thank you for that amendment that allows the effective date to be changed,” she said.

“It shows how much progress had been made, even before this legislation goes into effect,” Campos said of the hospital industry’s apparent shift in attitude. “It’s a monumental step, something that was not expected as recently as a few months ago.”

But Ly of the Chinese Progressive Association said he believes the Hospital Council still doesn’t want to see the city getting involved. “As recently as a month ago, their folks were speaking out against any kind of legislation. But I think they started seeing the writing on the wall.”

Ly fretted about the potential negative impact of Campos’ last-minute amendments. Sup. Campos’ plan represents a victory. But we could use that information as soon as possible. The 2013 deadline means the city will be handicapped: it will have information it can’t use yet.”

Ly ventures that the hospital industry’s approach will be to try to lessen the impact of the legislation. “As written, it still provides the Planning Commission and the board with the discretion to approve projects,” Ly said. “Ultimately, the struggle is about values. Just because there are plans and guidance doesn’t mean the healthcare needs of the community will become a top priority — it just provides us with tools to make an assessment.”

Campos counters that his bill will allow the city to create incentives for, and apply pressure on, the hospital industry. “If they truly want their projects to be expedited and approved before state-mandated seismic retrofitting deadlines kick in, they’ll propose plans that work for the community,” Campos explained.

But even as it publicly vows to be supportive, the Hospital Council continues to express concerns about the Campos legislation. “It’s the council’s job is to be supportive now that the board has approved Campos’ plan,” Smith said. “And Sup. Campos was very generous. He started talking to us in June. But we really didn’t get a handle on his proposal until much later. We think the idea of healthcare planning is very good. We still have concerns about the process, but now the board has voted on the legislation, our goal is to do our best to work with the law.”

Concerns that the legislation would be used to mire projects in repeated appeals and give too much weight to critics’ concerns was raised at the Nov. 16 hearing by Sup. Sean Elsbernd.

“Right now, if anyone has concerns, there’s a conditional use process and a CEQA [California Environmental Quality Act] process,” Elsbernd told the Guardian. “But this turns up a brand new appeal. It means the appeals are heard at the same time, but you’ve now created a third route.”

Campos responded to these concerns by amending the legislation to clarify that the board must act on consistency determination appeals at the same time it acts on other related appeals, so projects won’t be delayed.

Evidently this wasn’t enough to appease the San Francisco Chamber of Commerce. “We cannot be supportive of that piece of legislation,” Rob Black, the Chamber’s vice president of public policy, told the Guardian after the legislation was approved. “We believe appeals should be done at the Department of Public Health in conjunction with service providers, since San Francisco provides 20 percent of service, and private organizations provide the remaining 80 percent.”

Black says the Chamber was pleased Campos amended his legislation so as not to slow down projects that are currently in the planning pipeline. But he claimed Campos’ legislation could actually limit access to healthcare services. “The Chamber is concerned that Campos’ legislation will make it harder for doctors to pool together in pods, and if we don’t do that, it won’t make healthcare more available because services will be more expensive,” Black said. “But we absolutely think” the city should analyze gaps in providing health care to San Franciscans.

Campos’ aide Hillary Ronen confirmed that Black is correct in saying that anyone can appeal a hospital project’s consistency determination. “But the final analysis will revolve around asking if the proposed project meets the health care needs of San Francisco,” she said. “If it doesn’t, and the board doesn’t believe there’s a compelling public policy reason to approve the project, [the board] can override the approval.”

 

PATIENTS VS. PROFITS

Mary Michelucci, a registered nurse for 40 years and a member of the California Nurses Association, is hopeful that Campos’ legislation will rein in the hospital industry.

“I hope that any plan that would favor patient care over profit would be the way to go,” Michelucci said. “Running a hospital is expensive. But with the profits that Sutter and CPMC are making, they can afford this.”

Michelucci says the dispute over St. Luke’s came to a head three years ago, when nurses began to suspect that CPMC was planning to let the facility fail, suspicions that intensified when CPMC closed St. Luke’s neonatal intensive care unit 18 months ago.

“Now the babies who need neonatal special care are transported to CPMC’s California campus, which is in the Richmond,” Michelucci said. “But the moms may be discharged and most of them live in the Mission or Bayview-Hunters Point.”

Michelucchi still fears that CPMC will wage “a horrific campaign” against the California’s Nurses Association as it continues to push the plan for its megahospital. “CPMC wants to be in complete control of the registered nurses,” she said. “We, unfortunately, are their conscience, while they are a business model in the business of healthcare. The decisions they make about healthcare are not in the interests of patients or nurses, and we are the thorn in their side.”

All this is happening against the backdrop of the worst economic recession since the Great Depression, and for construction workers facing high unemployment rates in San Francisco, CPMC’s megaproject clearly represents light at the end of a very dark tunnel.

“CPMC is my future,” William Hestor, a 28-year-old father of two and member of SEIU-United Healthcare Workers, said at the Nov. 15 hearing. “We worked hard on a contract and we just want to make sure our hospital is built on time.”

CPMC media spokesperson Kevin McCormack told the Guardian that the real issue between CPMC and the CNA is union membership at CPMC’s Cathedral Hill facility. “CPMC is reducing beds at St. Luke’s because the beds aren’t in use, but the facility will be able to take care of 90 percent of patients’ needs and if you need specialist care, a shuttle will take you to Cathedral Hill,” McCormack said. “This centralized arrangement is the best way to attract the best staff and equipment.”

McCormack noted that there are union members and 1,200 nonunion nurses working at CPMC facilities in San Francisco. “We are bringing together nonunion and union nurses together at this facility, and we don’t feel we have the right to force our nonunion nurses to join,” he said, adding that since the Teamsters, the Carpenters, and SEIU-United Healthcare Workers (UHW) are already unionized at the Pacific and California campuses, they’ll be allowed to unionize at Cathedral Hill.

CNA member Eileen Prendiville, who has worked in San Francisco as a registered nurse for decades, recalls the negative changes she has already seen at CPMC’s facilities, including eliminating registered nurses and specialty services.

“If you pull services, as they have, of course you’ll have fewer patients. And the physicians start leaving, so it’s a vicious cycle,” she said. “St. Luke’s was a small community hospital but now it’s all about corporate medicine.”

Sup. Eric Mar sided with those seeking to exempt current projects from the city’s health care services master plan. But Sup. Sophie Maxwell noted that the Planning Commission will take a facility’s historical role into account in determining whether projects are consistent with the city’s health care services plan.

“We believe that addressed community concerns,” Maxwell said. “St. Luke’s would never have been targeted for closure had this legislation been on the books in the past.”

Campos insists his legislation is not simply about CPMC. “Ultimately this legislation stems from a number of pleas we have heard in the last couple of years from people throughout the city,” he said. “It takes the institutional master planning process to the next level. We have tried to consolidate the appeal process under existing law. Important as the legislation is, it’s key to make sure we have the right master plan because that’s where the heavy lifting will take place.”

Meanwhile, the final EIR is being completed for the CPMC project, which should go before the Board of Supervisors for approval early next year.

About that “far left beating…”

Our old pal Chuck Nevius is gloating about how the “far left” (I guess that means the people who would have been called mainstream Democrats a generation ago, the ones who believe in the public sector and think economic equality matters) got beaten badly in the supervisors races. And he uses Aaron Peskin as the personification of the far left (amusing, because if you actually talk to Peskin, and look at his record, he’s hardly a crazy leftist. And I say that as someone who is. A crazy leftist, I mean.)

Anyway, here’s what Nevius missed:

Malia Cohen is on the Board of Supervisors because of Aaron Peskin.

Look at what happened in the ranked choice voting. Cohen came from back in the pack because of second-place votes — and a lot of that was because the Democratic County Central Commitee put her as its #2 choice, after DeWitt Lacy, who didn’t run much of an effective campaign.

How did she get the #2? How did a candidate who is bad on tenant issues beat out Tony Kelly, who was by far the most progressive contender, at the supposedly “far left” DCCC? That was the work of Peskin — who, to the chagrin of a lot of progressives (including me) decided to vote for and promote Cohen as the second choice on the slate.

First of all, that was hardly the move of a “far leftist,” since Cohen certainly ran as a more moderate candidate. Second, it showed that the “far left” isn’t some giant organized hippie commie bloc led by Commisar Peskin; it’s a sometimes-united, often-fractious coalition that shares some interests and agendas but doesn’t always have its shit together.

Then there’s this notion the moderates swept into power. Actually, by chance of the way lines are drawn, the even-numbered seats have always been more conservative than the odd-numbered ones. In this case, in many of the races, the progressives were (to quote Calvin Welch) “playing with the house’s money.” Check it out:

D2: Janet Reilly would have been much more reasonable than Michela Alioto-Pier, but Mark Farrell won’t be any worse. Almost by definition, he can’t be any worse than Alioto-Pier. That was a conservative seat, and still is.

D4: No change at all, still Carmen Chu, still a moderate-to-conservative seat.

D6: I supported Debra Walker, but by no stretch of the imagination is Jane Kim anything but a progressive. She’ll be more conciliatory than Chris Daly, but that’s not difficult; Walker would have been more conciliatory, too. Different people, different personalities. But in the end, Kim will be a progressive vote; I mean, she started out as a Green Party leader. The “far left” held that district.

 D8: Definitely the house’s money. Scott Wiener won’t be a whole lot different on the issues than Bevan Dufty. If Rafael Mandelman had won, it would have been a net pickup for the left, but as it is, I’d call it a wash. Sure, the DCCC endorsed Mandelman and he lost, but we all know that was an uphill battle; Wiener has been working that district for years, had plenty of money, was better-known, had the support of Mark Leno, who once held that seat and is immensely popular in the district.   

D10: Sophie Maxwell was never part of the progressive bloc on the board. Sometimes she voted with them; sometimes she didn’t. Tony Kelly would have increased the size of the progressive majority; Malia Cohen doesn’t change it.

In two years, five key progressive seats will be on the ballot — Eric Mar seeking re-election in D1, David Chiu in D3, Ross Mirkarimi termed out and an open race in D5, and David Campos and John Avalos running again in D9 and D11. That’s where the battle to hold the progressive majority will be fought — and those are districts where the DCCC has more influence anyway.

In other words, since the return of district election, the progressives — the “far left” if that’s what you want to call us — have only held one of the five even-numbered seats, and still do. That’s not spin, Chuck; that’s reality.

 PS: Just for fun, I went back four years and checked out our endorsements for supervisor the last time the even-numbered seats were up. W endorsed Sophie Maxwell for re-election in D10 (with reservations, and lacking a credible progressive alternative) and Daly was re-elected with our support in D6. But our candidates lost in D2, D4 and D8.  Nobody talked about the left getting destroyed.

The next mayor

By the time a beaming Mayor Gavin Newsom took the stage at Tres Agaves, the chic SoMa restaurant, on election night, enough results were in to leave no doubt: the top two places on the California ballot would go to the Democrats. Jerry Brown would defeat Meg Whitman in the most expensive gubernatorial race in American history — and Newsom, who once challenged Brown in the primary and dismissed the office of lieutenant governor, would be Brown’s No. 2.

It might not be a powerful job, but Newsom wasn’t taking it lightly anymore. “We can’t afford to continue to play in the margins,” he proclaimed proudly, advancing a vague but ambitious agenda. “There is absolutely nothing wrong with California that can’t be fixed with what’s right with California.”

But around the city, as results trickled in for the local races, the talk wasn’t about Newsom’s role in the Brown administration, or the change the Democrats might bring to Sacramento. It was about the profound change that could take place in his hometown as he vacates the office of mayor a year early — and opens the door for the progressives who control the Board of Supervisors to appoint a chief executive who agrees with, and is willing to work with, the majority of the district-elected board.

At a time when the Republican takeover of Congress threatens to create gridlock in Washington, there’s a real chance that San Francisco’s government — often paralyzed by friction between Newsom and the board — could take on an entirely new direction. It’s possible that the progressives, long denied the top spot at City Hall, could put a mayor in office who shares their agenda.

This could be a turning point in San Francisco, a chance to put the interests of the neighborhoods, the working class, small businesses, the environmental movement, and economic justice ahead of the demands of downtown and the rich. All the pieces are in place — except one.

To make a progressive vision happen, the fractious (and in some cases, overly ambitious) elected leaders of the progressive movement will have to recognize, just for a little while, that it’s not about any individual. It’s not about David Chiu, or Ross Mirkarimi, or Chris Daly, or John Avalos, or Eric Mar, or David Campos, or Jane Kim, or Aaron Peskin. It’s not about any one person’s career or personal power.

It’s about a progressive movement and the issues and causes that movement represents. And if the folks with the egos and personal gripes and career designs can’t set them aside and do what’s best for the movement as a whole, then the opportunity of a generation will be wasted.

Folks: this is a hard thing for politicians to recognize. But right now it’s not about you. It’s about all of us.

It’s an odd time in San Francisco, fraught with political hazards. And it’s so confusing that no one — not the elected officials, not the pundits, not the lobbyists, not the insiders — has any clear idea who will occupy Room 200 in January.

Here’s the basic scenario, as described by past opinions of the city attorney’s office:

Under the state Constitution, Newsom will take office as lieutenant governor Jan. 3, 2011. The City Charter provides that a vacancy in the Mayor’s Office is filled by the president of the Board of Supervisors until the board can choose someone to fill the job until the end of the term — in this case, for 11 more months.

So if all goes according to the rules (and Newsom doesn’t try to play some legal game and delay his swearing-in), David Chiu will become acting mayor on Jan.3. He’ll also retain his job as board president.

On Jan. 4, the current members of the Board of Supervisors will hold a regularly scheduled Tuesday meeting — and the election of a new mayor will be on the agenda. If six of the current supervisors can agree on a name (and sitting supervisors can’t vote for themselves) then that person will immediately take office and finish Newsom’s term.

If nobody gets six votes — that is, if the board is gridlocked — Chiu remains in both offices until the next regular meeting of the board — a week later, when the newly elected supervisors are sworn in.

The new board will then elect a board president — who will also instantly become acting mayor — and then go about trying to find someone who can get six votes to take the top job. If that doesn’t work — that is, if the new board is also gridlocked — then the new board president remains acting mayor until January 2012.

There are at least three basic approaches being bandied about. Some people, including Newsom and some of the more conservative members of the board, want to see a “caretaker” mayor, someone with no personal ambition for the job, fill out Newsom’s term, allowing the voters to choose the next mayor in November, 2011. That has problems. As Campos told us, “The city has serious budget and policy issues and it’s unlikely a caretaker could handle them effectively.” In other words, a short-termer will have no real power and will just punt hard decisions for another year.

Then there’s the concept of putting in a sacrificial progressive — someone who will push through the tax increases and service cuts necessary to close a $400 million budget gap, approve a series of bills that stalled under Newsom, take the hits from the San Francisco Chronicle, and step out of the way to let someone else run in November.

The downside of that approach? It’s almost impossible for a true progressive to raise the money needed to beat a downtown candidate in a citywide mayor’s race. And it seems foolish to give up the opportunity to someone in the mayor’s office who can run for reelection as an incumbent.

Which is, of course, the third — and most intriguing — scenario.

The press, the pundits, and the mayor have for the past few months been pushing former Sup. Peskin as the foil, trying to spin the situation to suggest that the current chair of the local Democratic Party is angling for a job he wouldn’t win in a normal election. But right now, Peskin is no more a front-runner than anyone else. And although he’s made no secret in the past of wanting the job, he’s been talking of late more about the need for a progressive than about his own ambitions.

“If the board chose [state Assemblymember] Tom Ammiano, I would be thrilled to play a role, however small, in that administration,” Peskin told us.

In fact, Peskin said, the supervisors need to stop thinking about personalities and start looking at the larger picture. “If we as a movement can’t pull this off, then shame on us.”

Or as Sup. Campos put it: “We have to come together here and do what’s right for the progressive movement.”

Two years ago, the San Francisco left was — to the extent that it’s possible — a united electoral movement. In June, an undisputed left slate won a majority on the Democratic County Central Committee. In November 2008, Districts 1, 3, 5, and 11 saw consensus left candidates running against downtown-backed opponents — and won. In D9, three progressives ran a remarkably civil campaign with little or no intramural attacks.

The results were impressive. As labor activist Gabriel Haaland put it, “we ran the table.”

But that unity fell apart quickly, as a faction led by Daly sought to ensure that Sup. Ross Mirkarimi couldn’t get elected board president. Instead that job went to Chiu — the least experienced of the supervisors elected in that class, and a politician who is, by his own account, the most centrist member of the liberal majority.

This fall, the campaign to replace Daly in D6 turned nasty as both Debra Walker and Jane Kim openly attacked each other. Walker sent out anti-Kim mailers, and Kim’s supporters charged that Walker was part of a political machine — a damaging (if silly) allegation that created a completely unnecessary rift on the left.

And let’s face it: those fights were all about personality and ego, not issues or progressive strategy. Mirkarimi and Daly have never had any substantive policy disagreements, and neither did Walker and Kim.

In the wake of that, progressives need to come together if they want to take advantage of the opportunity to change the direction of the city. It’s not going to be easy.

“We’re good at losing,” Daly said. “I’m afraid we’re doing everything we can to blow it.”

The cold political calculus is that none of the current board members can count on six votes, and neither can Peskin or any of the other commonly mentioned candidates. The only person who would almost certainly get six votes today is Ammiano — and so far, he’s not interested.

“I know you never say never in politics, but I’m happy here in Sacramento. Eighty-six percent of the voters sent me back for another term, and I think that says something,” he told us.

It’s hardly surprising that someone like Ammiano, who has a secure job he likes and soaring approval ratings, would demur on taking on what by any account will be a short-term nightmare. The city is still effectively broke, and next year’s budget shortfall is projected at roughly $400 million. There’s no easy way to raise revenue, and after four years of brutal cuts, there’s not much left to pare. The next mayor will be delivering bad news to the voters, making unpleasant and unpopular decisions, infuriating powerful interest groups of one sort or another — and then, should he or she want the job any longer, asking for a vote of confidence in November.

Yet he power of incumbency in San Francisco is significant. The past two mayors, Newsom and Willie Brown, were reelected easily, despite some serious problems. And an incumbent has the ability to raise money that most progressives won’t have on their own.

Chiu thus far is being cautious. He told us his main concern right now is ensuring that the process for choosing the next mayor is open, honest, and legally sound. He won’t even say if he’s officially interested in the job (although board observers say he’s already making the rounds and counting potential votes).

And no matter what happens, he will be acting mayor for at least a day, which gives him an advantage over anyone else in the contest.

But some of the board progressives are unhappy about how Chiu negotiated the last two budget deals with Newsom and don’t see him as a strong leader on the left.

Ross Mirkarimi is the longest-serving progressive (other than Daly, who isn’t remotely a candidate), and he’s made no secret of his political ambitions. Then there’s Campos, an effective and even-tempered supervisor who has friendly relationships with the board’s left flank and with centrists like Bevan Dufty. But even if Dufty (who I suspect would love to be part of electing the first openly gay mayor of San Francisco) does support Campos, he’d still need every other progressive supervisor. Campos also would need Chiu’s vote to go over the top. Which means Chiu — who needs progressive support for whatever his political future holds — would have to set aside his own designs on the job to put a progressive in office.

In other words, some people who want to be mayor are going to have to give that up and support the strongest progressive. “If there’s someone other than me who can get six votes, then I’m going to support that person,” Campos noted.

Then there are the outsiders. City Attorney Dennis Herrera has already announced he plans to run in the fall. If the board’s looking for a respected candidate who can appeal to moderates as well as progressives, his name will come up. So will state Sen. Mark Leno, who has the political gravitas and experience and would be formidable in a re-election campaign in November. Leno doesn’t always side with the left on local races; he supported Supervisor-elect Scott Wiener, and losing D6 candidate Theresa Sparks. But he has always sought to remain on good terms with progressives.

All that assumes that the current board will make the choice — and even that is a matter of strategic and political dispute. If the lame duck supervisors choose a mayor — particularly a strong progressive — you can count on the San Francisco Chronicle, Newsom, and the downtown establishment to call it a “power grab” and cast doubt on the legitimacy of the winner.

“But choosing a mayor is the legal responsibility of this board and they ought to do their jobs,” Peskin said.

The exact makeup of the next board was still unclear at press time. Jane Kim is the likely winner in D6 and has always been a progressive on the School Board. She’s also close to Chiu, who strongly supported her. If Malia Cohen or Lynette Sweet wins D10, it’s unlikely either of them will vote for a progressive mayor.

Newsom also might try to screw things up with a last-minute power play. He could, for example, simply refuse to take the oath of office as lieutenant governor until after the new board is seated.

Chiu’s allies say it makes sense for the progressives to choose a mayor who’s not identified so closely with the left wing of the board, who can appeal to the more moderate voters. That’s a powerful argument, and Herrera and Leno can also make the case. The progressive agenda — and the city — would be far better off with a more moderate mayor who is willing to work with the board than it has been with the arrogant, recalcitrant, and distant Newsom. And if the progressives got 75 percent of what they wanted from the mayor (as opposed to about 10 percent under Newsom), that would be cause to celebrate.

But to accept that as a political approach requires a gigantic assumption. It requires San Franciscans to give up on the idea that this is still, at heart, a progressive city, that the majority of the people who live here still believe in economic and social justice. It means giving up the dream that San Francisco can be a very different place, a city that’s not afraid to defy national trends and conventional wisdom, a place where socioeconomic diversity is a primary goal and the residents are more important than the big companies that try to make money off them. It means accepting that even here, in San Francisco, politics have to be driven by an ever-more conservative “center.”

It may be that a progressive can’t line up six votes, that a more moderate candidate winds up in the Mayor’s Office. But a lot of us aren’t ready yet to give up hope.

Advocates say Steve Li is DREAM Act eligible

The Board of Supervisors plans to introduce a resolution at their Nov. 9 meeting denouncing the deportation of Shing Ma “Steve” Li, a  20-year-old DREAM Act student at City College of San Francisco, calling for Immigration and Customs Enforcement to grant him deferred action status, and urging Congress to pass the DREAM (Development, Relief and Education for Alien Minors) Act.

The move comes the same day San Francisco Unified School District Board President Jane Kim (leading in the as yet unresolved race to replace termed-out D6 Sup.Chris Daly) plans to introduce a similar resolution at the SFUSD Board meeting, and a week after City College Board Trustee Lawrence Wong introduced a resolution supporting Li, who has lived in California since 2002 and is studying to be a nurse , but is now in an immigration detention center in Arizona.

“It’s unreal how fast things change”, Li said in a statement made from Arizona, just seven weeks after ICE raided his home and arrested him.

Li, who is ethnically Chinese, was born in Peru as his parents fled political persecution in China. And  ICE is allegedly preparing to deport him to Peru, which he left when he was 12. (Calls to ICE had not been returned as of blog post time, but I’ll update this blog, when I get a reply.)

“He knows no one in Peru,” said Li’s lawyer, Sin Yen Ling, senior staff attorney at the Asian Law Caucus, as she described how Li’s grandma returned to China, when his grandfather died.

Five years ago, the U.S. denied Li’s parents political asylum from China and issued a removal order. But Li says he was unaware of his immigration situation until his home was raided, and advocates and community members believe his case illustrates how the U.S.’s immigration system tears up families and targets contributing members of society.

Li’s Sept. 15 arrest occurred one week before Congress failed to vote on the DREAM Act, which would provide a pathway to legalization to undocumented students who’ve grown up in the US and atten two years of college or served two years of the military.

“It’s critical to pass the DREAM Act before the new Congressional session, but Steve literally cannot wait and is set for deportation any day now, that’s why we need our Senators’ leadership today,”  Li’s attorney Sin Yen Ling told me, noting that so far their has been no response from Sen. Dianne Feinstein, and that advocates are planning to target Sen. Barbara Boxer, now that the election is over.

In their resolution, Board President David Chiu and Sups. Eric Mar, John Avalos, David Campos and Ross Mirkarimi note that the DREAM Act is “bipartisan legislation that addresses the situation faced by young people who were brought to the United States years ago as undocumented immigrant children, and who have since grown up here, stayed in school, and kept out of trouble.”

These five supervisors note that each year, 65,000 U.S.-raised students who qualify from the DREAM Act’s benefits graduate. They also note that Democratic Sen. Dick Durbin and Republican Sen. Richard Lugar asked Department of Homeland Security Secretary Janet Napolitano on April 21, 2010 to halt the deportation of immigrant students who could earn legal status under the DREAM Act, which has the support of the House and Senate leadership, all of the relevant committee chairs, the nation’s military leaders, and President Barack Obama.

“I will do whatever it takes to support efforts to pass this bill so I can sign it into law on behalf of students seeking a college education and those who wish to serve in our country’s uniform. It’s the right thing to do,” Obama told the Congressional Hispanic Caucus on September 15, 2010—the same day that Li was arrested in San Francisco.

Update: Since writing this blog, I got a call back from ICE’s Lori Haley, who said she was limited in how much information she could share, but sent me this statement concerning Li:

“Shing Ma Li was taken into custody by ICE Fugitive Operations team officers on September 15, 2010, based upon a final order of removal issued by an immigration judge in 2004.  In 2005, the Board of Immigration Appeals (BIA) reviewed his case and upheld the immigration judge’s decision.  Shing Ma Li currently remains in ICE custody while the agency seeks to make arrangements for his removal.”

 

Get a clue, Randy Shaw

I read BeyondChron every day, and Randy Shaw, who operates the site, and Paul Hogarth, his managing editor, often have interesting commentary. But I’m constantly annoyed by people who run what by any stretch is a journalistic operation, but don’t follow the basic rules of (even alternative, activist) journalism: When you’re going to say something nasty about somebody, you call that person for comment.


Randy never called me, or Steve Jones, or Bruce Brugmann, before he launched an attack on the Guardian as part of a political machine. If he had — or if he’d done any reporting work and called around town — he might have learned something.


Randy’s argument is that the “machine” — including the Bay Guardian — is trying to block Jane Kim’s election as D6 supervisor. Let’s examine that for a minute.


There are plenty of people in San Francisco who would love to have a political machine. But it’s just not happening. The very fact that Jane Kim has the support of so many progressives — including the Board president, David Chiu, and Supervisors Eric Mar and John Avalos (all part of what Shaw calls the “machine”) suggests that nobody has to clout — not even me — to tell a candidate whether she can run for office, to control (or cut off) campaign contributions, or to wire an election.


In the days when Willie Brown ran San Francisco, the machine really did keep people from running for office. It really did close off avenues to political advancement. And if the machine was against you, it was really hard to raise money. If Brown were still the boss, and he didn’t want Kim to run, she would have been frozen out of much of the support and money she has today. Instead, Brown was at her campaign kickoff — and nobody’s manged to intimidate her many supporters and campaign contributors.


And guess what? The Guardian — the axis of the machine evil trying to freeze out Kim — endorsed her as our second choice.


I stand by what I said months ago — there’s nobody in San Francisco today — and no cadre or group — with the clout to operate as a political machine.


Nobody can line up six automatic votes on the Board of Supervisors. Even the progressives on the Democratic County Central Committee can’t always seem to get it together (note that Aaron Peskin, the chair and supposed machine honco, supported Tony Kelly for supervisor, and the DCCC didn’t put Kelly on its slate).


Right now, power in this city is fairly diffuse. That’s both a good and a bad thing. Good because machines are exclusionary, bad because it means the progressives can’t always function on a level that gets the right candidates elected and the right legislation through. Good because the left in this city is aggressively, almost happily disorganized and politically diverse, full of characters, voices, interest groups, candidates and elected officials who don’t always agree with each other and take orders from nobody. Bad because when we’re disorganized, we tend to lose.


Jane Kim didn’t get the DCCC endorsement. Nobody talked to me about that; I’m not on the panel and none of the members called to ask my advice. I would have said what the Guardian said in our endorsement package: There are exactly two progressive candidates who are qualified to be the next D6 supervisor, and their names are Debra Walker and Jane Kim. I still don’t understand why Kim entered the race against an established candidate with whom she has no substantial policy disagreements; I think that, before Kim moved to the district and entered the race, Walker was the clear consensus candidate of progressives, and as a matter of strategy, since Kim and Walker are both on the same side on the key issues, it might have made more sense for the left to unite behind one candidate.


But that’s not the issue anymore; Kim had every right to run, and now any cogent, honest ranked-choice voting strategy includes both her and Walker.


That statement alone makes clear that the Guardian’s not exactly in synch with the DCCC or any of Shaw’s other “machine” operations. The DCCC decided that the top candidate in D10 should be DeWitt Lacy, and left Tony Kelly off the slate entirely. We endorsed Tony Kelly as our first choice. The labor activists on the DCCC (and in the “machine”) are dead set against Margaret Brodkin winning a seat on the Board of Education; we endorsed her.


I would have explained our positions to Randy Shaw if he’d called or emailed me; I’m really easy to reach. And slapping people around without talking to them is bad journalism and bad progressive politics. Randy and I have disagreements, but I don’t consider him the enemy; we’re both part of a larger progressive community, and while I love (and thrive on) disputes in that community, we ought to be civil about it.


(I always contact Randy before I write about him. I did that yesterday, and asked him a series of questions, including why he never called me for comment. His non-response: “I write 3-4 articles a week and have published three books. You are free to quote from anything I have written without asking me about it.”)


Herb Caen used to say (somewhat in jest) that if you “check an item, you lose it.” In other words, once you start talking to everyone involved in an issue, you sometimes find out that the story isn’t at all the way you heard it.


That’s what should have happened with Shaw’s completely inaccurate claim about Steve Jones.


BeyondChron says that Jones was trying to get Kim to challenge Carmen Chu in D4 because they’re both Asian-American, ” in effect saying that as an Asian-American Jane should run among ‘her people,’ implying that demographics prevailed over issues and political stands.”


I talked to Steve about it; he did, indeed, talk to Jane Kim when Kim was shopping around for a district to run in. What he told her — and would have told Randy Shaw — was that it would be great for Kim, a school board member with citywide name recognition, to knock off Carmen Chu and expand the progressive majority rather than going after a strong progressive candidate in a solidly progressive seat. Race had nothing to do with it.


In fact, just about everything we’ve written about Kim comes down to the same argument: Sometimes, you have to think about the larger progressive movement, not just about yourself.


I sometimes wish the all the people who say the Bay Guardian is part of a powerful Peskin Machine were right: I’d love to pass a city income tax, hit the wealthy up for about half a billion dollars a year, eliminate the budget deficit without cutting services, municipalize PG&E (and have municipal cable TV and broadband), ban cars on a lot of streets, create 25,000 units of affordable housing … I’ve got a great agenda. And the Guardian’s so powerful that none of it ever happens.


Randy Shaw and I were both around for the tail end of the Burton Machine, and I think he gives the brothers Phil and John Burton too much credit. They were great on national issues, progressive champions in Congress. But they weren’t progressive leaders on local issues.


The Burton Machine was nowhere on the fights against overdevelopment and downtown power. Phil Burton rarely used his clout to support progressive causes and candidates at home. The machine got Harvey Milk fired from a commission appointment when he announced he was going to run for state Assembly against Art Agnos. The machine came together to make sure that Nancy Pelosi, an unknown who had never held office, got elected to Congress instead of Harry Britt, the most progressive elected official in the city at the time. The machine never helped out on public power, the numerous anti-highrise initiatives, rent control, or much of anything else that challenged the real estate interests like Walter Shorenstein, who gave vast sums of money to the Democratic Party.


Yes, George Moscone, a Burton ally, supported district elections, but once he got elected he stopped challenging downtown power.


And, of course, when Willie Brown emerged as heir to the machine throne, he was a disaster for progressives. He also at one point controlled an unshakable majority on the Board of Supervisors; he could call up votes whenever he needed.


The progressives in San Francisco today share an ideology on local issues — tough local issues that involve powerful economic forces at home.


And honestly, Randy: It’s not all about Jane Kim.


 

Endorsements 2010: San Francisco ballot measures

PROP. AA

VEHICLE REGISTRATION FEE

YES

Proposition AA would add $10 to the existing annual fee for vehicles registered in San Francisco, which would bring in about $5 million a year in desperately needed funds for public transit and other environmentally friendly modes of transportation. Proceeds would help to fund new bike infrastructure, pedestrian crosswalks, and transit reliability projects. Some would also be spent on street repairs — with top priority given to streets with bikeways and public transit routes. Unless Muni and bike infrastructure improves, it’s hard to persuade drivers to leave their cars at home and choose greener ways of getting around. Prop. AA is in line with the city’s transit-first goals, and it will be a step toward reducing traffic congestion and helping public transit. Vote yes.

 

PROP. A

EARTHQUAKE RETROFIT BOND

YES

This $46.15 million general obligation bond to support seismic upgrades for wood-framed buildings is an important means of protecting San Franciscans in an earthquake and preserving affordable housing. A 2009 report by the Department of Building Inspection found that 151 buildings that received government affordable housing support — 8,247 units in all — could be destroyed in the next big earthquake.

Unfortunately, most of these buildings are break-even ventures for their owners, who have no incentive to put the money into needed seismic upgrades. This measure would fund those improvements with grants and deferred loans, which would accrue interest but would only need to be paid back if the owner makes a profit or tries to convert the building to another use, providing further guarantees that the housing will remain affordable even after an owner’s obligation to the state or federal governments ends. Vote yes on Prop. A.

 

PROP. B

CITY RETIREMENT AND HEALTH PLANS

NO, NO, NO

Back when the great national health care reform debate was raging, the Guardian advocated for a single-payer system, which would have cut out health insurance companies altogether. What we got instead was a bill that requires everyone to buy health insurance. Now endlessly rising health insurance costs pose a problem for the city — in years of financial stress, it must make ever-larger payments to cover public employees’ health benefits. The blame for this dysfunctional system should be pinned on health insurance companies, not public employees. After all, the industry spent millions lobbying federal lawmakers to preserve a system in which they are solidly guaranteed to make millions off the backs of taxpayers.

But Prop. B, introduced by Public Defender Jeff Adachi, asks public employees to bear the brunt of these ballooning costs. It would also require them to contribute up to 10 percent of their pay to fund retirement benefits. One of the most compelling arguments against Prop. B was articulated by Assemblymember Tom Ammiano in a recent Guardian editorial: “A single mother will be forced to pay up to $5,600 per year for her child’s health care — in addition to the $8,154 she already pays.” That cost would be the same whether the employee earns $40,000 or $100,000 annually — and that’s just unfair. Prop. B would deal the greatest blow to the people who have the least. But there’s a broader consequence, too — take this kind of money out of the pockets of working people and you’ve done just the opposite of stimulating the economy.

Adachi wrote and circulated his measure without negotiating with city employee unions or seeking a solution that would be less harsh and regressive. We’re all for reviewing the city’s pension and health care costs. But making the lowest-paid city workers take the same hit as the overpaid managers is no answer. Vote no on B.

 

PROP. C

MAYOR APPEARANCES AT BOARD

YES

If you feel like you’ve seen this measure before, that’s because you have — an advisory measure asking the mayor to show up once a month and answer questions at the Board of Supervisors passed overwhelmingly in 2006. But Mayor Gavin Newsom ignored it, and a tougher measure failed the next year after Newsom raised $250,000 to defeat it.

Now the problem is worse than ever. In a year in which back room negotiations and underhanded political tactics marred the city budget approval process and other legislative initiatives, progressive supervisors are again trying to get Newsom and future mayors to engage in a political dialogue, in public, to determine what’s best for the city. This is precisely how the people’s business should be done, in an open and transparent way that respects the role that these two branches of government are supposed to play in running the city. Besides, won’t it be fun to watch? Vote yes.

 

PROP. D

NONCITIZEN VOTING IN SCHOOL BOARD ELECTIONS

YES

Sponsored by Board President David Chiu and Sups. David Campos, Eric Mar, John Avalos, Ross Mirkarimi, Sophie Maxwell, Chris Daly, and Bevan Dufty, this charter amendment would extend the right to vote in local school board elections to San Francisco residents who are parents, guardians, and caregivers of children who attend school in San Francisco, regardless of whether these residents are U.S. citizens.

One-third of San Francisco residents are foreign-born. Parental involvement has been determined as a critical factor in children’s education — and this measure only applies to elections for the Board of Education. Vote yes.

 

PROP. E

ELECTION DAY VOTER REGISTRATION

YES

In an era of growing political apathy and cynicism, anything that draws more people into the electoral process is a good thing. So this common sense measure by Sup. Ross Mirkarimi to remove one more barrier to participation in elections is a positive step.

Current state law requires eligible voters to register at least 15 days before an election. Prop. E would allow any city resident to simply show up at a polling place on Election Day, register to vote, and participate in a municipal election. Eight other states currently offer same-day voter registration. Vote yes.

 

PROP. F

HEALTH SERVICE BOARD ELECTIONS

NO

Sup. Sean Elsbernd, who sponsored this measure, says it will save the city money be consolidating elections for the board that oversees the city employee health care fund. But it won’t save much — $30,000 a year, at most — and the unions that represent the people who are served by this board say risks turning board elections into more expensive and complex political contests. Vote no.

 

PROP. G

TRANSIT OPERATOR WAGES

NO

We understand the motivations behind this measure — Muni drivers are the only city employees who don’t have to engage in collective bargaining for wages and work rules. Instead, the City Charter guarantees them the second-highest salary level of all comparable transit systems in the nation. Although that’s not an unreasonable salary level given that Muni is perhaps the country’s most challenging transit system and San Francisco has one of the highest cost of living price tags in the country, no city workers should have their salaries set this way.

We also agree that many of Muni’s work rules need to be changed and that removal of the salary guarantees would give the city more leverage to make those changes. We even agree that Transport Workers Union Local 250 hasn’t done itself any favors and should have been a better partner in this year’s difficult city budget process.

But we oppose Prop. G, which inappropriately seeks to blame Muni’s problems on its drivers and would set a new standard for collective bargaining that could hurt workers and perhaps make Muni more dangerous to pedestrians and others.

Like all city employees, Muni drivers are banned from going on strike. In exchange, the city agrees to binding arbitration if contract talks reach an impasse. But this measure adds a factor that exists in no other city union contract: the arbitrator would have to consider whether a proposed contract could negatively affect service.

While that might seem benign or even appropriate, the reality is that everything from driver rest breaks to assisting those with disabilities to the expectations of how fast drivers can complete a route all potentially affect service, forcing the arbitrator into positions of agreeing with city officials who have been choosing the politically expedient path of trying to squeeze more out of Muni without trying to give it the resources it needs to operate safely, efficiently, and reliably.

Earlier this year, progressive supervisors tried to craft an omnibus Muni reform measure that removed driver pay guarantees from the charter while also trying to get it more money and make critical changes in how the system is governed, an effort the TWU supported but that the supervisors ultimately abandoned. That’s the kind of balanced approach the system needs and it ought to be revived. In the meantime, vote no on G.

 

PROP. H

LOCAL ELECTED OFFICIALS ON POLITICAL PARTY COMMITTEES

NO

This one’s a pure political vengeance act by Mayor Newsom, who is unhappy that the local Democratic Party is controlled by progressives who oppose his initiatives. The measure would bar elected officials in San Francisco from serving on the Democratic or Republican County Central Committee. It’s almost certainly unconstitutional — the parties get to decide their own membership rules — and has no rationale at all except the mayor’s personal sour grapes. Vote no.

 

PROP. I

SATURDAY VOTING

YES

Okay, we’re suspicious of Prop I. The sponsor is Alex Tourke, a political consultant whose client list isn’t exactly a roster of progressive San Francisco. And it’s a little funky — it calls for an experiment in opening the polls the Saturday before the next mayoral election, with the costs covered by private donations. And the idea of private interests paying for an election strikes us as bad policy.

But at its base, the idea is sound. Tuesday voting is a very old idea that makes no sense in the modern age. We’d much rather see Election Day held at a time when most people aren’t working. In fact, we’d rather see the polls open for a week, not just one day. And this is a one-time test to see if weekend voting might increase turnout. Vote yes.

PROP. J

HOTEL TAX CLARIFICATION AND TEMPORARY INCREASE

YES

There are two competing hotel taxes on the November ballot: Prop. J and Prop K. Prop. K contains a poison pill: if both measures pass, whichever gets the most votes take effect. Both J and K try to address legal insufficiencies in San Francisco’s existing hotel tax, but Prop. J also asks visitors to pay a slightly higher tax — about $3 a night (the cost of a latte) — for the next three years.

Currently the way hotel taxes are assessed allows some online customers to avoid part of the tax. When a customer books a hotel room through an online booking service like Expedia or Orbitz, the hotel tax is only assessed on the amount that a hotel receives, not the amount that the website charges the customer. In other words, if a website sells a room to an online customer for $150 a night, but only $120 of that goes to the hotel, the customer is charged hotel tax on the lower amount. If Prop. J passes, the customer will have to pay a hotel tax on the full amount paid to the online booking service. The measure would also eliminate a loophole that allows airlines to book rooms for flight crews without paying any tax. Those changes are expected to generate at least $12 million a year. The $3 increase in the hotel tax will generate another $26 million.

The Chamber of Commerce and Convention and Visitors Bureau say the measure could hurt tourism — but it’s hard to imagine how somebody will decide not to visit San Francisco because of a $3 a night fee. Vote yes.

 

PROP. K

HOTEL TAX CLARIFICATION

NO

Put on the ballot by Mayor Newson at the behest of large hotel corporations, Prop. K also seeks to close loopholes in the hotel tax. But Prop. K doesn’t include a tax increase, meaning that it will contribute millions less to the city’s General Fund at a time when San Francisco is having trouble balancing its budget, leading to ongoing cuts in city staff and services.

Prop. K’s a direct attempt to undermine Prop. J. Vote no.

 

PROP. L

SITTING OR LYING ON SIDEWALKS

NO, NO, NO

What kind of a city is San Francisco? If proponents of Prop. L, the Civil Sidewalks Ordinance, were to be believed, it’s a city where nothing is done when uncivil people harass pedestrians, drink on the sidewalk, or pee in public. Even though Prop. L purports to address this kind of behavior, all it really does is outlaw sitting or lying on public sidewalks.

We think San Francisco is the kind of city that is smart enough to reject this dumb idea. The Prop. L proponents like to say it’s about public safety, but there is nothing inherently unsafe about sitting or lying down on the sidewalk. Street poets sit at their typewriters to sell sonnets to tourists. The tamale lady sometimes sits while selling her tasty Mexican treats. Day laborers sit when they get tired of standing around waiting for work. Many people who live on the streets lie down to sleep beside their shopping carts. If Prop. L passes, there is nothing to guarantee that buskers, day laborers, homeless people, partygoers, people with bad knees, or anyone else would not be harassed by police for the simple act of sitting.

But even if there are people squatting on the sidewalk harassing passersby, how is this law going to change that? All they have to do is stand up — which would still be legal. If they persist, and the police arrest them, the city will be on the hook for millions of dollars in costs for prosecution, defense, and incarceration.

The notion that the ordinance would only be used against troublemakers is problematic too, since a law that is selectively enforced could open the door to legal headaches. Prop. L is misguided, draconian, unnecessary, and the wrong direction for San Francisco. Vote no.

 

PROP. M

COMMUNITY POLICING AND FOOT PATROLS

YES

Prop. M offers an enlightened alternative to Prop. L. Introduced by Sup. Ross Mirkarimi, it would require the chief of police to establish a comprehensive beat patrol program, with cops on the beat, to deal with the safety and civility issues Prop. L seeks to address. It would also direct the Police Commission to adopt a written community policing policy, involving police interactions with the community, focusing police resources on high crime areas, and encouraging citizen involvement in combating crime. Prop. M also has a poison pill: if the voters adopt both M and L and M gets more votes, then the law against sitting or lying down on the sidewalk would not take effect. So a yes vote for Prop. M is kind of like another no vote against Prop. L. Vote yes.

 

PROP. N

REAL PROPERTY TRANSFER TAX

YES

With the city facing a massive structural budget deficit, it’s hard to argue against a measure that would bring in an average of $36 million without hurting anyone except the buyers and sellers of very high-end property — that is, big corporations and exceptionally wealthy individuals. Prop. N would slightly increase the tax charged by the city on the sale of property worth more than $5 million. Vote yes.

Apathy and the arboretum

OPINION Nobody believed it could happen, that the ordinance might pass. On the face of it, it seemed inconceivable. The very idea that visitors would have to pay to enter a public park appeared absurd, and had been rejected only the year before. Some believed the hype and were convinced that this would help solve the budget deficit. Others expected someone besides themselves would take action, or believed that that the $7 fee, once imposed, would apply only to nonresidents.

So, by and large, people sat on their hands. Meanwhile, the San Francisco Botanical Garden Society at Strybing Arboretum, the driving force behind the privatization of the arboretum in Golden Gate Park, was using the camouflage of hard times to mask the absurdity of its proposal. The way had been carefully paved. A real estate developer and Bolinas resident handpicked by Mayor Gavin Newsom to head the Recreation and Park Commission voiced his enthusiasm. The rubber-stamp commission he heads passed it on to the Board of Supervisors. Despite the presence of his grandfather’s native plant garden within the arboretum, the mayor lent his support.

The society had craftily employed lobbyist Sam Lauter, who had set up meetings between individual supervisors and wealthy trustees.

The strategy succeeded. Astonishingly, only three supervisors voted against the ordinance imposing a fee on entrance to the arboretum. Leading the charge for the measure was John Avalos, who had added a “sunset” clause along with other vaguely worded amendments. At the hearing, the ever-congenial Chris Daly accused opponents of “elitism.” No public comment was permitted, and no supervisor questioned Recreation and Parks Department head Phil Ginsberg, although Eric Mar did announce his intention to join the Botanical Garden Society.

Much was made about union jobs — as though holding three gardeners’ salaries hostage to the passing of a privatization ordinance was a reasonable proposition.

As things stand now, the society is planning to allow its members free admission to the arboretum. Given that the reason for the $7 fee is all about the budget, this makes no logical sense. Low-income people and the undocumented (not to mention the homeless) will be excluded.

The society is also planning to build a $13 million glorified greenhouse that would have its own entrance on John F. Kennedy Drive. No community discussion has been held, but that has not deterred the society from soliciting the state to pay $7 million toward this so-called “sustainable gardening center,” an edifice that would likely memorialize the likes of Dede Wilsey or similar donor.

So what’s a good citizen to do? If you value public free space, the wings of the society need to be clipped. The best way to do this is to directly contact the offices of your supervisors, especially Sups. John Avalos (554-6975), David Campos (554-5144), David Chiu (554-7450),Michela Alioto-Pier (554-7752), Sean Elsbernd (554-6516) and Carmen Chu (554-7460). And vociferously voice your feelings.

Otherwise, the fee will not sunset next year — or any year.

With fewer than 10 weeks to go until a pivotal November election, the San Francisco Democratic County Central Committee (DCCC) approved a package of endorsements at its Aug. 11 meeting, giving the nod to mostly progressive candidates and rejecting Mayor Gavin Newsom’s most divisive ballot measures.

This crucial election could alter the balance of power on a Board of Supervisors that is currently dominated by progressives, and that new board would be seated just as it potentially gets the chance to appoint an interim mayor.

That’s what will happen if Newsom wins his race for lieutenant governor. The latest campaign finance reports show that Newsom has raised twice as much money as the Republican incumbent, former state Sen. Abel Maldonado. But the two candidates are still neck-and-neck in the polls.

Although the DCCC supports Newsom in the race, it is resisting his agenda for San Francisco, voting to oppose his polarizing sit-lie legislation (Prop. L), a hotel tax loophole closure (Prop. K) that would invalidate the hotel tax increase that labor unions placed on the ballot, and his hypocritical ban on local elected officials serving on the DCCC (Prop. H).

Shortly after the vote, the San Francisco Chronicle reported that Newsom called an emergency closed-door meeting with some of his downtown allies to discuss the upcoming election. “We just wanted to get on the same page on what’s going on locally, what’s going with the ballot initiatives, where people are on the candidates for supervisor,” Newsom told the newspaper.

DCCC Chair Aaron Peskin, who regularly battled with Newsom during his tenure as president of the Board of Supervisors, voted with the progressive bloc against Newsom’s three controversial measures. But he told us that he was glad to see the mayor finally engage in the local political process.

Sup. David Campos kicked off the DCCC meeting by rebuffing newly elected DCCC member Carole Migden’s unsuccessful attempt to rescind the body’s endorsement of Michael Nava for Superior Court Judge, part of a push by the legal community to rally behind Richard Ulmer and other sitting judges.

Things got even messier when the DCCC endorsed the candidates for supervisor. In District 2, the DCCC gave the nod to Janet Reilly, snubbing incumbent Sup. Michela Alioto-Pier, who is running now that Superior Court Judge Peter Busch has ruled that she is not termed out (a ruling on City Attorney Dennis Herrera’s appeal of Busch’s ruling is expected soon).

In District 6, where candidates include DCCC member Debra Walker, School Board President Jane Kim, Human Rights Commission Executive Director Theresa Sparks, neighborhood activist Jim Meko, and drag queen Glendon Hyde (a.k.a. Anna Conda), the club endorsed only Walker, denying Kim the second-place endorsement she was lobbying for.

But in District 8, where candidates include progressive DCCC member Rafael Mandelman, moderate DCCC member Scott Wiener, and moderate Rebecca Prozan, the politics got really squirrelly. As expected, Mandelman got the first-place nod with 18 votes: the progressive’s bare 17-vote majority on the 33-member body plus Assembly Member Leland Yee.

Yet because Yee supports Prozan and David Chiu, the Board of Supervisors president who was also part of the DCCC progressive slate, had offered less than his full support for Mandelman, a deal was cut to give Prozan a second-place endorsement.

That move caused some public and private grumbling from Jane Kim’s supporters, who noted that Kim is way more progressive than Prozan and said she should have been given the second-place slot in D6.

A proxy for John Avalos even tried to get the DCCC to give Walker and Kim a dual first-place endorsement, but Peskin ruled that such a move was not permitted by the group’s bylaws. Then DCCC members Eric Mar and Eric Quezada argued that Kim should get the club’s second-choice endorsement.

But Walker’s supporters argued that Kim only recently moved into the district and changed her party affiliation from the Green Party to the Democratic Party, and Kim’s supporters failed to find the 17 votes they needed.

“District 6 has an amazing wealth of candidates and I look forward to supporting many of them in future races,” Gabriel Haaland told his DCCC colleagues. “I will just not be supporting them tonight.”

Wiener told the group he would not seek its endorsement for anything below the top slot. “I’m running for first place and I intend to win,” Wiener said, shortly before Prozan secured the club’s second-choice endorsement.

In District 4, the DCCC endorsed incumbent Carmen Chu, who is running virtually unopposed. The DCCC also endorsed Bert Hill’s run for the BART Board of Directors, where he hopes to unseat James Fang, San Francisco’s only elected Republican.

The body had already decided to delay its school board endorsements until September and ended up pushing its District 10 supervisorial endorsement back until then as well because nobody had secured majority support.

“I think it’s because they want to give members of the DCCC a chance to learn more about some of the candidates,” District 10 candidate Dewitt Lacy told the Guardian. “I don’t think folks have spent enough time to make an informed decision.”

D10 candidate Chris Jackson agreed, adding, “The progressives in this race have brought our issues to the forefront.”

“I think it’s appropriate,” concurred D10 candidate Isaac Bowers. “D10 is a complicated district. It’s wise to wait and see how it settles out.”

The main thing that needs to be resolved is which candidate in the crowded field will emerge as the progressive alternative to Lynette Sweet, who has the support of downtown groups and mega-developer Lennar Corp.

After the meeting, Walker said different races require different political strategies. “I think it’s hard in the progressive community, where so many of us know each other and even our supporters know the other candidates and are their supporters in other scenarios,” Walker said.

“But the Democratic Party makes decisions not just based on politics,” she continued. “So the endorsement is about being viable and successfully involved in Democratic issues. And even though I want to encourage everyone to run, and we have that ability with ranked choice voting and public financing, when it comes to straight-on politics, the goal is winning.”

Walker said the vote on D8 reflected the reality that Mandelman was having trouble getting the necessary number of votes. “I know Rebecca and I know Rafael, and Rafael was my clear first choice,” Walker said.” Rafael asked me to consider voting for Rebecca—and I voted for her as my second choice.”

Walker predicts she’ll have union support behind her campaign, while Kim, who leads in fundraising, will have independent expenditure committees that will support her campaign.

“My consultant says it’s a $250,000 race, and unfortunately the viability is based on that reality, the funds, the money,” Walker observed.

On the fall ballot measures, the DCCC voted to recommend a no vote on Public Defender Jeff Adachi’s measure to make city employees pay more for the pension and healthcare costs (Prop. B), Sup. Sean Elsbernd’s Health Service Board Elections (Prop. F,) and Newsom’s three controversial measures. And they voted “no endorsement” on Elsbernd’s measure to remove from the charter Muni pay guarantees (Prop. G). 

But the DCCC did vote to endorse a local vehicle registration fee surcharge (Prop. AA), Newsom’s earthquake retrofit bond (Prop. A), Sup. Chris Daly’s proposed legislation to require mayoral appearances at board meetings (Prop. C), Chiu’s measure to allow noncitizen voting in school board elections (Prop. D), Sup. Ross Mirkarimi’s Election Day voter registration (Prop. E), former Newsom campaign manager Alex Tourk’s Saturday voting proposal (Prop. I) Labor’s hotel tax (Prop. J ), Mirkarimi’s foot patrols measure (Prop. M) and Avalos’ real estate transfer tax (Prop. N).

With just about everybody opposed to Adachi’s measure going after public employee unions, Walker observed that Adachi probably wishes he had done it differently now. But looking into the future, Walker sees opportunities for the party to come back together.

“There’s an opportunity to start a dialogue because everyone is hurting,” Walker said. “The more we don’t have a proactive solution, the more we get caught at the bottom.”

And in a feel-good vote for the frequently divided body, the DCCC also voted overwhelmingly to endorse the statewide initiative to legalize and tax marijuana (Prop. 19). Normally local party committees don’t take a position on state initiatives, but because the California Democratic Party took no position on Prop. 19, the DCCC had permission to weigh in.

As Peskin put it before the enthusiastic marijuana vote, “Raise your hands — high.”

Chiu left out of Gascon’s Community Ambassadors loop

SFPD Chief George Gascon kicked off today’s press conference about a Community Ambassadors program on the Third Street corridor by saying that it’s a grassroots pilot.

“This is not a police program, it’s a community program,” Gascon said, as he introduced Adrienne Pon from the Mayor’s Office to speak about what is being framed as a trailblazing effort to address violence on public transit at a time when money is tight all around.

Board President David Chiu, Sups. Carmen Chu, Sophie Maxwell and Eric Mar, and Chinese Chamber of Commerce consultant Rose Pak were also in attendance and everyone was all smiles and put on an apparent show of solidarity for what appears to be a desperately needed program

But Chiu did not know that the press conference was happening, when I called him last night for details. I’d assumed that he would be in the loop as the Board President and the most visible of the city’s top Asian American political leaders. But as Chiu confirmed today, he only was briefed a few hours before it took place.

Asked what was going on, Chiu waxed diplomatic.
“As you know, I didn’t know about it yesterday when you called,” Chiu said. “So, when I heard about it, I called the Chief and he sent the information. I’m happy this is happening.”

Oddly, when I called the SFPD this morning to confirm that today’s press conference was happening, I was asked who had told me about it. By then, I also knew that D. 10 candidate Marlene Tran was going to be speaking at the press conference. And while it’s great that Tran is an advocate for public safety programs, it’s weird that a candidate on the November ballot was in Gascon’s press conference loop, when Board President Chiu was not.

“We are in a neighborhood with serious public safety concerns,” Chiu told reporters today. “The issues that come from one of our ethnic communities are of concern for us all.

“We are working with the Mayor’s Office and the Chief,” Chiu continued, noting that the Board has been working hard to restore funding for violence prevention programs and to ensure there is funding for a new program for translation services.

“A multi-ethnic program is the type of program we need to move the healing process forward,” Chiu said, thanking the SFPD and the District Attorney’s Office for working to help victims of violence get help and translation services.

Sup. Maxwell talked about how the Ambassadors Program will be good for seniors, young people and very very young people.
“We need to make sure we continue these kinds of programs,” Maxwell said.

Sup. Eric Mar thanked AT& T for providing cell phones to the 12 outreach workers who have been trained as Community Ambassadors.
And Pon of the Mayor’s Office promised that this would be the first of many efforts to address public safety concerns.
‘There is no place for violence in the community,” Pon said. “Any time anyone gets hurt, it rips a hole in the fabric of society. It’s not just the recent acts of physical violence and threats against some of our residents. No one should have to contend with being spit upon and name-calling and threats.”

Thanking Sharen Hewitt, Rose Pak and “the courageous community members who came forward,” Pon said the pilot program will last until mid-September and will focus on the Number 9-San Bruno bus and the T-Third line. Funding is coming from the city’s general fund and federal job stimulus funds.

“Unfortunately, those funds are going to end in September, so we’re looking for funding from the corporate community,” Pon said, referring to AT&T.

She described the Community Ambassadors program as a “non-law enforcement presence.”
“People can get along regardless of their cultural and linguistic differences,” Pon said.

AT& T California President Ken McNeely talked about his company’s “long and storied history”, noting that the first transcontinental call happened over 100 years ago and involved a call from San Francisco’s Chinatown to New York City.

“We’re in the business of really connecting people,” McNeely said.

Sup. Carmen Chu said the pilot program is the beginning of efforts to build community across ethnic lines.
“It starts to sends a message about what we want to accomplish,” Chu said.
“Crime is not something we want to see tolerated,” Chu continued.

On August 3, the Board considered legislation that Chu authored to implement higher penalties for crimes on and around Muni. Like the Community Ambassadors program, Chu’s legislation came in response to recent attacks on Asian Americans by African-American teens. In one case, a group beat a 57-year-old woman then pushed her onto the tracks. In another, an 83-year-old man died in the hospital after he was assaulted.

If passed, Chu’s legislation would increase the penalties for aggressive pursuit and loitering while carrying a concealed weapon to $1,000 if the crime occurred on or around MUNI (as opposed to $500 for the same crime committed elsewhere.) The Board also recommended that juveniles convicted of these crimes be given community service or in-home sentences instead of probation or juvenile hall.

Police Commission President Dr. Joe Marshall was also on hand today to voice his enthusiasm for the Community Ambassadors pilot.
“This is pretty cool,” Marshall said. “We got a model. I don’t know if any other cities are doing this, but they should be. I commend the ambassadors for being involved.”

And D. 10 candidate Marlene Tran said the program represented an opportunity to work “for peace and harmony.”
“This is an auspicious occasion,” Tran said, noting that there would be “double happiness” in the Asian American community over two community hubs, one in Viz Valley, the other in the Bayview.
“We encourage more collaboration amongst our community,” she said.

Rose Pak, consultant to the Chinese Chamber of Commerce, hinted that she would be squeezing more money out of AT&T.
“I knew we had a problem, and I knew who to go to,” Pak said, noting that she wasn’t not going to let AT&T “get away with pilot support.”
“I expect them to write a big check,” she said.

Pon told reporters that the Community Ambassadors speak a total of seven languages: English, Cantonese, Mandarin, Vietnamese, Spanish, Samoan and Hawaiian.

But when reporters asked how City Attorney Dennis Herrera’s newly announced gang injunction against two warring street gangs, the Down Below Gangsters and Towerside Gang, in Viz Valley, might be compromised by the Community Ambassadors program, Gascon stepped forward.
“If thoughtfully implemented, gang injunctions can be a powerful tool,” Gascon said, noting he believes the Community Ambassadors will be a model that “we’d like to take to other neighborhoods.”

But how can 12 people armed solely with AT&T cell phones and fluorescent yellow jackets tackle what seems primarily to be youth violence against Asians? And what will happen in six weeks when the pilot program’s funding dries up?
“For the past two weeks, and continuously until mid-September, they are going through training at the SFPD and the MTA,” Pon said, noting that some of this training involved cultural and linguistic competency training.

“We’re building a pilot,” Pon continued. “The phones are preprogrammed to speed dial the SFPD, and we recruited these 12 ambassadors from over a hundred candidates in the Jobs Now program’s census outreach team. So, they are used to working in public and are comfortable with working with individuals of diverse backgrounds and ethnicities.

Pon acknowledged that the pilot has a shoestring budget.
“We are seeking private and foundation funding, so I’ll be doing lots of grant writing,” Pon continued, noting that a permanent program would need “at least half a million dollar budget.”

Asked if the Mayor’s Office was kept in the loop about today’s event more than Chiu, Pon smiled.

“SFPD called the conference and we are all making sure that we are working together,” Pon said.

But AT&T’s Ken McNeely was happy to talk about his company’s efforts to provide cell phones for connecting with first responders.
“Public-private partnerships are critically important,” McNeely told the Guardian.
“We’ve made education one of our key pillars for giving back,” he said. “ For us all to do well, it’s going to take public private partnerships.”

The deal is done

Mayor Gavin Newsom was quick to frame the Board of Supervisors’ 10-1 vote for Lennar Corp.’s massive redevelopment proposal for Candlestick Point-Hunters Point Shipyard on July 27 as a sign that plans to revitalize the Bayview are about to begin.

“Now we can truly begin the work of transforming an environmental blight into a new center of thousands of permanent and construction jobs, green technology investment, affordable housing, and parks for our city,” Newsom claimed in a prepared statement after the board (with Sup. Chris Daly as the lone dissenter) approved Lennar’s 700-acre project.

The proposal calls for 10,500 residential units; 320 acres of parks, retail and entertainment facilities, green-tech office space; and a San Francisco 49ers stadium if the team decides not to move to Santa Clara.

But Kofi Bonner, who worked for Mayor Willie Brown before becoming Lennar’s top Bay Area executive in 2006, said the vote means he can start shopping the plan around. “Now we have to find some money to move forward with the project,” Bonner told the San Francisco Chronicle.

Given the stubbornness of the recession, Bonner’s revelation that Lennar has yet to find all the necessary investors means local workers and public housing residents could be waiting a long time for jobs and housing in Bayview. If and when the project finally breaks ground, it will involve building condos in the Bayview’s only major park.

These realities undermine the claims of Lennar, which used the mantra of “jobs, housing, and parks” in 2008 to sell Proposition G but made no mention of a bridge over environmentally sensitive Yosemite Slough or selling state parkland for condos.

Also disturbing, says Sierra Club local representative Arthur Feinstein, is the lack of any economic analysis to support Lennar’s claims that the bridge is needed.

Indeed, the only thing clear to longtime observers of the plan is that the much vaunted jobs won’t happen soon, most of the housing will be unaffordable to current Bayview residents, and Candlestick Point State Recreation Area, the only major open space in the Bayview, will be carved up so Lennar can build luxury condos on waterfront land.

These concerns have led the Sierra Club to threaten a lawsuit over issues on which Board President David Chiu was the swing vote in favor of the Lennar and Redevelopment Agency plan. Yet Chiu told the Guardian that the process got him thinking that it might be time to reform the redevelopment process.

“Now might be a good time to address concerns about the potential for inconsistency between Redevelopment and the city when it comes to land use and planning visions,” Chiu said. “And I have concerns about the tax increment financing process.” Tax increment financing allows the Redevelopment Agency to keep all property tax increases from the project, up to $4 billion, to use in redevelopment projects rather than into city coffers.

Chiu says the amendment he offered July 12, which narrows Lennar’s proposed bridge over Yosemite Slough by half, was based “on the belief that having a connection between jobs and housing is important. And I had understood that it would cost the developer an additional $100 million if the bridge was removed.”

But Feinstein counters that it’s hard to imagine that building a bridge over an environmentally sensitive slough will attract investors that support green technology. He is concerned that the development is expected to attract 24,465 new residents but that the Lennar plan fails to mitigate for transit-related impacts on air quality. “The Bayview already has the highest rates of asthma and cancer in the city,” Feinstein said.

Chiu says the supervisors can introduce separate legislation to address this concern. “It’s my understanding that an air quality analysis could be implemented by the board,” he said.

Although the board’s July 27 vote was a relief for termed-out Sup. Sophie Maxwell, its failure to support the no-bridge alternative, increased affordability standards, and an air quality analysis could result in expensive and time-consuming litigation, Feinstein warns.

And although Sups. Chris Daly, Ross Mirkarimi, David Campos, John Avalos, and Eric Mar supported all three of these amendments, they were ultimately thwarted by a redevelopment law that limits the city’s control of such projects.

During the meeting, Daly acknowledged that it would be impossible for Lennar to meet his 50 percent affordability amendment. But he noted that if the project becomes too expensive “there’s going to be a pretty new neighborhood with lots of white folks living in the Bayview.”

But after Michael Cohen, Newsom’s top economic advisor, said the project would not be financially viable with 50 percent affordability, Sups. Chiu, Maxwell, Bevan Dufty, Michela Alioto-Pier, Carmen Chu, and Sean Elsbernd voted against Daly’s amendment.

These same six supervisors voted against Mirkarimi’s proposal to eliminate plans for a bridge across Yosemite Slough, even though Cohen was unable to point to any economic analysis to support Lennar’s claims that the bridge is necessary.

Arc Ecology owner Saul Bloom, whose nonprofit did studies indicating that an alternative route wrapping around the slough is feasible, says Lennar’s plan illustrates the problem that San Francisco has with development. “Elected officials couldn’t do anything,” he said, except give the nod to a plan he describes as “developed by a mayoral administration and approved by that mayor’s political appointees [on the Redevelopment Agency board],” Bloom said.

“The message that the environmental community takes away from all this is that it doesn’t pay to play well,” Bloom continued. “No matter how much you spend to try and ensure that litigation is not the only way to obtain the desired outcome, ultimately the message that comes back from the city and the developer is ‘sue us!’ That brings out the worst political conduct, not the most appropriate.”

Feinstein wouldn’t confirm that a Sierra Club lawsuit is imminent, but predicted that if the coalition — which includes Golden Gate Audubon, the California Native Plant Society, and SF Tomorrow — goes to court, it’s likely to win. “If we do litigate, we’ll probably do it on a wide range of issues,” Feinstein said. “They approved a fatally flawed document, and they could provide no documented evidence of the need for a bridge — and admitted that publicly.”

Feinstein contends that Lennar’s plan has been a runaway project from the get-go. “The idea was to march it through before the mayor is gone with little regard for process. And despite all the much vaunted public meetings, little in the plan has changed,” he said.

Feinstein added that he was disappointed in Chiu’s stance on the bridge. “There were five supervisors in the Newsom camp, but as board President, Chiu had a responsibility to be more vigilant,” he said. “We told him what’s wrong with the bridge plan, but he didn’t share our view.”

“This is a rare opportunity,” Maxwell said before the board’s final vote. “It focuses public and private investment into an area that has lacked it in the past. It’s unmatched by any development project in San Francisco. This project is large and complicated, no doubt. But let us not be fearful of this project because of its scale, because how else can we transform a neglected landscape?”

But project opponents say everyone should fear a deal that required the board to ask Lennar’s approval to amend a plan that was pitched by the Newsom administration and approved by a bunch of mayoral appointees on the Redevelopment Commission with little chance for elected officials to make changes.

Mirkarimi said the problem with a process in which redevelopment law trumps municipal law is that it creates a shadow government in those few municipalities in California where the Board of Supervisors or City Council is not the same entity as the Redevelopment Commission.

“This is not the first time Redevelopment’s plans have trumped the concerns of local residents,” Mirkarimi said, referring to the agency’s botched handling of the Fillmore District in the 1960s, which led to massive displacement of African and Japanese Americans.

“I’ve been told, ‘Don’t worry, Ross, this is not going to happen, we’re not going to use eminent domain.’ Well, jeez, that’s a consolation, because even when we’ve exercised our legislative influence and given our blessing, [Redevelopment] unilaterally changed the plan after it left the board,” Mirkarimi said, referring to Lennar’s decision to replace rental units with for-sale condos when it first began work on the shipyard in 2006. “That suggests a condescending role in which the developer is able to go to the Redevelopment Commission and make a unilateral change.”

Mirkarimi’s concerns seemed justified after Cohen, Bonner, and Redevelopment Director Fred Blackwell huddled in a corner of City Hall during the board’s July 27 meeting to decide which of the supervisors’ slew of amendments they would accept. When Cohen returned with the amendments organized into three categories (acceptable as written, to be modified, and completely unacceptable), Mirkarimi’s no-bridge amendment had been sorted into the “unacceptable” pile.

“With regard to your insistence on the economic reasons [for the bridge], please point to which document says that,” Mirkarimi said, leafing in vain through the project materials.

Cohen mentioned “a lessening of attractiveness,” “a lower-density product,” and a reduction of revenue available through tax increment financing to pay for the bridge.

“Yes, but I’m still trying to look for the information and all I’m hearing is this pitch,” Mirkarimi said. “The economic study is absent. There are no supporting documents here. This is why I feel it’s justified for us to have a review of this.”

Cohen rambled on about “rigorous public discussion over a number of years” and claimed that a “huge amount of studies had been done.”

“But there is no economic study,” Mirkarimi repeated.

The board then voted 6-5 against Mirkarimi’s amendment after deputy City Attorney Charles Sullivan said that the only way to remove the bridge — since the project’s environmental impact report had rejected that option — would be to reject the entire plan. “I wish we had been able to eliminate the bridge,” Campos told the Guardian after the vote. “Part of the challenge we have is to reexamine how Redevelopment works and explore the potential for taking it over.”

Daly believes the bridge has nothing to do with connecting the neighborhood to the city. “The idea is to allow white people to get the fuck out of the neighborhood,” he said. “And it connects a different class of people to a new job without having to go through a low-income community of color. That’s why the bridge is needed.”

Mirkarimi said he was satisfied that he had dissected the arguments against the no-bridge alternative but fears that institutional memory is lacking on the current board. “A lot of my colleagues have not been involved in the debacle,” he said, referring to decades of problems with redevelopment in San Francisco. But Maxwell was all smiles. “I did my homework a long time ago — that’s why they couldn’t touch the core of the project,” she said. “They just added to and augmented it.”

The Board of Supervisors found itself in the humiliating position July 27 of having to ask for the approval of Lennar and the city’s Redevelopment Agency before it could amend Lennar’s massive redevelopment plan for Candlestick Point-Hunters Point Shipyard.

If that’s not an argument for reforming how this city approaches redevelopment, I don’t know what is. Especially since the Board’s meeting illustrated only too well how thoroughly Lennar’s local executives, who used to work for the city under Mayor Willie Brown,  understand this game and how to outfoxed any resistance to their ongoing effort to eat San Francisco whole.

“This is a rare opportunity,” Sup. Sophie Maxwell said ahead of the Board’s 10-1 vote (Sup. Chris Daly was the lone dissenting voice) to approve Lennar’s entire plan. “It focuses public and private investment into an area that has lacked it in the past,”continued Maxwell, who represents the district that encompasses the shipyard and Candlestick Point. ” It’s unmatched by any development project in San Francisco. This project is large and complicated, no doubt. But let us not be fearful of this project because of its scale, because how else can we transform a neglected landscape?”

But who wouldn’t be afraid of a deal that found Maxwell, Board President Chiu and Sups. Michela Alioto-Pier, Carmen Chu, Bevan Dufty and Sean Elsbernd joining forces to vote against Sup. Ross Mirkarimi’s proposal that Lennar be required to include a non-bridge alternative?

And who wouldn’t be doubly afraid, given that these six supervisors took that vote after Michael Cohen, Mayor Gavin Newsom’s top economic advisor, was unable to point to a single document to support his claims that Lennar’s $100 million bridge over an environmentally sensitive slough is actually needed?

Talk about scary.

To his credit, Mirkarimi did a good job of illustrating what’s wrong with a process that allows a private developer like Lennar to pitch plans and get mayoral appointees to approve them, but doesn’t allow San Francisco’s elected officials to make any amendments unless the developer and Redevelopment agree.

At the root of this travesty is the fact that redevelopment law trumps municipal law, a power imbalance that creates a shadow government in those few municipalities in California where the city council or board of supervisors is not the same entity as the Redevelopment Commission.

San Francisco is one such municipality, and, as Mirkarimi explained, this is not the first time that Redevelopment’s plans have trumped the concerns of local residents.

“I’m the supervisor for the Fillmore, the first urban renewal laboratory took place in my district, and I vowed to never let it happen again, ”Mirkarimi said, referring to the massive displacement of African Americans and Japanese Americans that took place when Redevelopment decided to makeover the Fillmore in the 1960s.

“I’ve been told, “Don’t worry, Ross, this is not going to happen. We’re not going to use eminent domain,’” Mirkarimi continued. “Well, Jeez, that’s a consolation! Because even when we’ve exercised our legislative influence and given our blessing, [Redevelopment] unilaterally changed the plan after it left the Board. That suggests a condescending role in which the developer is able to go to the Redevelopment Commission and have a unilateral change.”

Mirkarimi was referring to how proposed rental units on Parcel A, the first parcel of shipyard land released for redevelopment, became for-sale condos at Lennar’s request, without the Board having any recourse, even though the area surrounding the redevelopment is ground zero for the city’s last remaining African American community and home to other low-income communities of color.

Deputy City Attorney Charles Sullivan explained that the s supervisors would require the approval of the developer and Redevelopment to amend Lennar’s latest plan, under Redevelopment law. Failing that, their only recourse would be to reject Lennar’s plan in its entirety–a nuclear option that only Daly seemed prepared to carry through.

Sup. David Campos noted that the city’s legal advice had been “somewhat of a moving target.” His comment suggested the Board had  been misled in the critical weeks before this final vote, including ahead of the Board’s July 14 vote to accept certification of the project’s final environmental impact report.

“When a number of us raised questions about the EIR, we were told we couldn’t, but that we would probably be able to make changes to the substantive plan,” Campos recalled. “But now we are getting a more complicated answer.”

Deputy City Attorney Sullivan said the situation was complicated, because some of the proposed amendments “don’t involve a simple stroke of the pen.”

But Campos pointed to the fact that Board President Chiu had introduced an amendment that only allows for a 41 ft. bridge across Yosemite Slough, thereby halving the width of the 82 ft. bridge that Lennar is proposing to build.

That amendment, which Chiu introduced July 12,  leaves the door open for the 82 ft. version of the bridge, if the 49ers indicate interest in a new stadium on Hunters Point Shipyard, a possibility the city claims is still alive, even though Santa Clara voters approved a new stadium for the 49ers this June.

“So, why can you amend the plan to include a scaled-down version of the bridge but not eliminate it altogether?” Campos asked.

“You can make that motion by voting not to approve the project,” Sullivan said.

“So, the change has to point to something already embedded in the project?” Campos asked.

“Or not be a rejection of everything that’s already been brought forward,” Sullivan replied.

After Mirkarimi proposed his no-bridge alternative, along with a slew of other amendments that Daly, Campos, and Sups. Eric Mar and John Avalos had been working on to strengthen the proposed development, Cohen, Mayor Gavin Newsom’s top economic advisor, huddled somewhere in City Hall along with Kofi Bonner,  Lennar’s top local executive and Fred Blackwell, the head of SF’s Redevelopment Agency to decide which of the Board’s amendments they would accept.

Cohen returned with the amendments organized into three categories: acceptable as written, modified, and completely unacceptable.

And predictably enough (to anyone  tracking Lennar’s insistence on a bridge) Mirkarimi’s no-bridge amendment had been tossed into the “unacceptable” pile.

Cohen talked some more about “rigorous public discussion over a number of years.”

“But there is no economic study,” Mirkarimi repeated. At which point a deafening silence pervaded the Board’s venerable chambers, much as if the emperor had shown up without his proverbial clothes.

Deputy City Attorney Sullivan broke the silence by indicating that the only way for the Board to move a no-bridge alternative forward would be to stop all project approvals and send the plan back to Redevelopment.

And Mirkarimi reminded the supervisors that at the Board’s July 13 hearing, Cohen had said that there was no conclusive evidence around the need for the bridge.

But then the Board voted 6-5 against Mirkarimi’s proposal, a move insiders said was more about not pissing off Labor, which hopes to create jobs for iron workers, and not pissing off Lennar, whose control runs deep and wide, and less about being convinced of the actual need to build over the last unbridged waterway in the city’s southeast sector.

And a couple of amendments later, the Board gave its blessing and it was all kisses and hugs and applause in the Board Chambers, even though the folks from Dwayne Jones Communities of Opportunities (COO) program, who usually show up to support the plan, strangely weren’t in attendance, rumoredly because their program has been cut off at the knees in the last few weeks, following Jones resignation as COO’s director.

“I wish we had been able to eliminate the bridge,” Campos told me after the Board’s final vote. “I think part of the challenge we have is to reexamine how Redevelopment works and explore the potential for taking it over.”

Mirkarimi was satisfied that he had dissected the arguments against the no-bridge alternative, but feared that institutional memory is lacking on the Board, and that without fundamental Redevelopment reform, the city is in danger of seeing this kind of travesty repeated, over and over.

“A lot of my colleagues have not been involved in the debacle,” Mirkarimo said, referring to how Redevelopment’s infamous role dates back five decades, and how Lennar has been working the local political scene for longer than most of the Board’s current members.

But Maxwell was all smiles.
“I did my homework a long time ago, that’s why they couldn’t touch the core of the project,” she said. “They just added to and augmented it.”

With Maxwell’s days on the Board drawing to a close, I asked what she’s contemplating doing next.

“Sophie is looking into water policies and conservation,” Maxwell said. “Without blue there is no green.

It was about then that Mayor Gavin Newsom released a press statement that blabbed on in vaguely frothing terms about what would happen next.

“Now we can truly begin the work of transforming an environmental blight into a new center of thousands of permanent and construction jobs, green technology investment, affordable housing and parks for our City,” Newsom said

His words came shortly before Bonner said that Lennar would now start looking for investors, and shortly after Cohen admitted that it could be years before anything in Lennar’s plan actually gets built. But none of them mentioned that the Sierra Club and other environmental groups are planning to sue the City over the bridge, an outcome that could have been averted, Sierra Club officials warned, if the No-bridge alternative had been  included in the final redevelopment plan.

City Hall standoff

Backroom politics, vote-trading, threats, and tricky legislative maneuvering marked — some would say marred — the approval of the city’s 2010-11 budget and a package of fall ballot measures.

For weeks, Mayor Gavin Newsom had been threatening to simply not spend the roughly $42 million in budgetary add-backs the supervisors had approved July 1, mostly for public health and social services, unless they agreed to withdraw unrelated November ballot measures that Newsom opposes (see "Bad faith," July 14).

The board’s July 20 meeting included a flurry of last-minute maneuvers interrupted by an hours-long recess during which Newsom, Board President David Chiu, and their representatives negotiated a deal that was bristled at by progressive supervisors and fiscal conservative Sup. Sean Elsbernd.

Ideological opposites Elsbernd and Sup. Chris Daly voted against motions to delay consideration of several measures — including splitting appointments to the Rent, Recreation and Park, and Municipal Transportation Authority boards; revenue measures; and requiring police foot patrols — until after approval of the city budget.

"What is the connection between [seismic retrofit] bonds and the budget?" Elsbernd asked as Budget Committee chair John Avalos made the motion to delay consideration of the $46 million general obligation bond Newsom proposed for the November ballot.

Avalos made an oblique reference to "other meetings" that were happening down the hall. Daly then criticized the maneuver, noting that "vote trading is illegal," later citing a 2006 City Attorney’s Office memo stating that supervisors may not condition their votes on unrelated items.

But that didn’t stop supervisors from engaging in a complex, private dance with the Mayor’s Office and other constituencies that day. In the end, the board approved the budget on a 10-1 vote, with Daly in dissent. Then Chiu provided the swing vote to kill the progressive proposal to split with the mayor appointments to the Recreation and Park Commission, with Sups. Daly, Avalos, Ross Mirkarimi, David Campos, and Eric Mar on the losing end of a 5-6 vote to place the measure on the fall ballot.

A measure to split appointments to the Rent Board was defeated on a 10-1 vote, with Daly dissenting, although that seems to be tactical concession by progressives. Campos, who sponsored the measure, said landlord groups were threatening an aggressive campaign against the measure that would also seek to tarnish progressive supervisorial candidates.

Removal of an MTA reform measure from the ballot, another mayoral demand, was also likely at the July 27 meeting (held after Guardian press time). Chiu told his colleagues July 20 that he was still negotiating with the mayor on implementing some of its provisions without going to the ballot this year.

Chiu rejected the notion that he cut an inappropriate budget deal, saying he was concerned the split appointment measures would be portrayed as a board power grab, noting that community groups need the funding that Newsom was threatening to withhold, and saying the board’s threats not to fund Newsom’s Project Homeless Connect facility and Kids2College Savings program were also factors in the deal.

"We were engaged with a number of conversations, they all took time, and we didn’t finish until very late," Chiu told us.

Even Daly acknowledged supervisors had few options to counter Newsom’s threats, but told us, "It’s just not the way we should be doing things."

The decision on three revenue measures (a parking tax increase, property transfer tax, and business tax reform) was set for July 27, with sources telling the Guardian that only one or perhaps two would make it onto the ballot. Newsom opposes all of them. Also hanging in the balance was Mirkarimi’s ballot measure requiring police to do more foot patrols, as well as another version in which Chiu added a provision that would invalidate the Newsom-backed ordinance banning sitting or lying on sidewalks, a retaliation for Newsom inserting a similar poison pill in his hotel tax loophole measure that would invalidate the hotel tax increase that labor put on the ballot if it gets more votes.

But most of the action was on July 20. The Transportation Authority (comprised of all 11 supervisors) voted 8-3 (with Chiu, Avalos, and Mar opposed) to place a $10 local vehicle license fee surcharge on the ballot, which would raise about $5 million a year for Muni. A Daly-proposed ballot measure to create an affordable housing fund and plan failed on 4-7 vote, with only Campos, Mar, and Chiu joining Daly.

There were some progressive victories as well. A charter amendment by Mirkarimi to allow voters to register on election day was approved 9-2, with Elsbernd and Alioto-Pier in dissent. A Chiu-proposed measure to allow non-citizens to vote in school board elections was approved 9-2, with Elsbernd and Carmen Chu voting no. And a Daly-proposed charter amendment to require the mayor to engage in public policy discussions with the board once a month was approved 6-5, opposed by Dufty, Alioto-Pier, Elsbernd, Maxwell, and Chu.

But the busy day left some progressives feeling unsettled. "How do you do this and not be trading votes?" Campos told us. "In the end, we’re saving programs, but what does it say about the institution of the board?"

Newsom spokesperson Tony Winnicker denied that the mayor made inappropriate threats, but confirmed that a deal was cut and told us, "Yes, the Mayor made his concerns about the budget clear. Yes, the mayor made his concerns about the charter amendments clear."

The board wanted to overhaul those departments (and give the board some appointments) because they’re a mess; the Rec-Park Commission, appointed entirely by the mayor, is a rubber-stamp agency that votes with nearly 100 percent unanimity on every issue. The MTA has served as a slush fund for the police department at a time when bus lines are cut and fares keep going up.

Newsom told board members that he could, indeed, restore the funding they wanted; the money was there. But he wouldn’t. In other words, he would allow desperately ill people to be turned away from SF General for lack of a bed — if the board didn’t stand down on its reforms. And by a 6-5 margin, with Board President David Chiu providing the critical vote for the mayor’s agenda, the board went along with the deal.

Even worse: Chiu and his colleagues gave up their charter amendments. But the mayor didn’t give up his: a Newsom measure that would prevent elected officials (like Chiu) from serving on the Democratic County Central Committee is still on the ballot.

Five of the progressives on the board hung tough, and Sups. John Avalos, David Campos, Chris Daly, Eric Mar, and Ross Mirkarimi deserve credit for refusing to accept a bad, embarrassing deal.

But in the end, the board got rolled. The mayor played tough and a majority of the supervisors folded. If a supervisor proposes trading one piece of legislation for another, it would violate state law. That doesn’t apply to the mayor — but it should. The board should immediately pass legislation outlawing vote trading for all local elected officials, including the chief executive. Let’s see if Newsom wants to veto that.

Rumors fly that Board can’t amend Lennar deal, after all

For the past month, fireworks and deals have been going on at City Hall as the Board prepares to vote on Lennar’s massive redevelopment plan for Candlestick Point-Hunters Point Shipyard. And recently, the Board vowed to make a slew of amendments to the plan, even as they approved the project’s environmental impact report.

But now it’s beginning to look like the only winners could be the developer—and perhaps those folks at city hall who are staking their political careers on jamming this deal over the finish line, come hell or high water, before the November election comes around and they go into the private sector as real estate developers.

I say this because two weeks ago, the progressives on the Board were saying that they had been told that they couldn’t amend the EIR July 14, but that they could amend the actual redevelopment plan when it comes before them on July 27. It was for this reason, they said, that they decided to vote to accept the EIR in an 8-3 vote, with only Sups. John Avalos, Chris Daly and Eric Mar, voting to reject the project’s key environmental document.

But today, with less than two working days before the Board’s July 27 meeting, I’m hearing rumors that the Board will only be able to take an up and down vote, when they consider Lennar’s actual redevelopment plan.

In other words, the only way the Board would be able to change anything would be to reject the plan in its entirety.But everyone knows that this is a pigs-may-fly scenario, given the massive pressure the Mayor’s Office, labor and Lennar have been exerting on the Board.

So, if these “up-and-down-vote only” rumors turn out to be true, folks who care about environmental and economic justice better start sounding the alarm. Because there is a plethora of unresolved issues that Sups. John Avalos, David Campos, Chris Daly, Eric Mar, and Ross Mirkarimi identified July 13 as needing shoring up, before the actual redevelopment plan would ever pass their sniff test.

These concerns included fears that the project’s financing plan amounts to daylight bank robbery, that the proposed bridge across the Yosemite Slough is unnecessary, and that the amount of projected air pollution related to the development is unacceptable.

And then there’s the fact that the Controller’s “economic benefits” report only used averaged figures, and therefore did not give any details about how many jobs and benefits the project would create in this economically depressed community in the next few years.

And did I mention the part about liquidated damages and watershed concerns? Or the fact that there are no maritime uses in the current plan, even though these uses could translate directly into relatively unskilled jobs, if old ships were broken up at the shipyard.

But despite the hours of discussion on July 13 that the Board sat through last week, I do not recall anyone from the Mayor’s or City Attorney’s Office advising the supervisors that they would not be able to amend the actual plan when it comes before them July 27.

Right now, a lot of confusion is swirling as folks point to the fact that Board President David Chiu introduced five amendments at a July 12 Land Use Committee hearing that eight supervisors subsequently voted to accept. This move led the rest of the Board to believe that they too could make amendments to the final plan.

But a review of Chiu’s amendments and the project’s EIR suggests that these changes are in fact repackaged pieces of the EIR, and that the move misled other supervisors into believing that that they would have a chance to amend the actual redevelopment plan.

So far, no one from the Mayor’s Office has returned my calls seeking clarification on this process. But if it turns out that the only way the Board can have input is to kick the plan to the curb, or ask the Planning Commission to make new findings, then democracy in San Francisco has been replaced with an empty charade.

“The Board can make changes along the line that David made in the Land Use Committee, “ Chiu’s legislative aide Judson True told me today. But he wasn’t clear on the process next week, and suggested that I call Cohen’s office, which I did (only to find myself shunted to Cohen’s voice mail.)

So, what gives? And why would the Board allow an out-of-town developer in partnership with the Mayor’s Office to sidestep its responsibility in this way?

“We were told we could not make amendments to the EIR, but could make amendments to the plan that we will be voting on this Tuesday,” Campos told me today, noting that he and Mirkarimi were prepared to make changes July 13, but were then told they could not do that.

“The biggest fear I have with this project, and any project this size in this economy, is that a lot is promised, but will anything get developed, or will we be stuck holding the bag,” Campos added.

Similar questions led the Alameda city council to kick developer SunCal to the curb last week. Ironically, the move could open the door to a developer like Lennar to try and swoop in and pick up the pieces in the island city across the Bay from San Francisco.

But folks in Alameda are pointing to San Francisco as an example of how difficult it is to nail down developers, noting that Michael Cohen, Mayor Gavin Newsom’s top financial advisor, recently admitted that investment money is scarce, even though the city’s EIR for the project has been approved.

Actually, Cohen went a step further by intimating that all the benefits that the community wants out of the plan would deter investors even more—comments that were perhaps just a precursor to this potential bombshell that the Board won’t actually be able to amend the deal, after all? Stay tuned.

Lennar Corp.’s massive redevelopment plan for Candlestick Point-Hunters Point cleared a critical hurdle July 14 when the Board of Supervisors voted 8-3 to affirm the Planning Commission’s certification of the project’s final environmental impact report, with Sups. John Avalos, Chris Daly, and Eric Mar opposed

Board President David Chiu called the vote "a milestone." Termed-out Sup. Sophie Maxwell, whose District 10 includes Candlestick Point and the former Hunters Point Naval Shipyard, saw the vote as evidence that city leaders support the ambitious plan. Yet many political observers saw the vote as proof that Lennar and its Labor Council allies have succeeded in lobbying supervisors not to support opponents of the project.

"I’m concentrating on pushing this over the finish line," Maxwell said at the hearing in the wake of the vote, which came in the wee hours of July 14 after a 10-hour hearing. Supervisors can still amend Lennar’s development plan during a July 27 hearing and project opponents are hoping for significant changes.

Mar said he wants to focus on guaranteeing that the city has the authority to hold Lennar responsible for its promises. "I want to make sure that we have the strongest enforcement we can," he said.

Lennar’s plan continues to face stiff opposition from the Sierra Club, the Golden Gate Audubon Society, the California Native Plant Society, San Francisco Tomorrow, POWER (People Organized To Win Employment Rights) and CARE (Californians for Renewable Energy).

Representatives for these groups, whose appeals of the EIR certification were denied by the board, say they are now weighing their options. Those include taking legal action within 30 days of the board’s second reading of and final action on the developer’s final redevelopment plan, which will be Aug. 3 at the earliest.

Supervisors are expected to introduce a slew of amendments July 27, when they consider the details of the proposal and its impacts on the economically depressed and environmentally polluted.

Michael Cohen, Mayor Gavin Newsom’s top economic advisor, admitted July 19 that all these various demands will likely delay project construction. "But 702 acres of waterfront land in San Francisco is an irreplaceable asset," Cohen reportedly told the San Francisco Chronicle. "It’s not a question of if — but when — it gets developed."

Chiu already has introduced five amendments to the plan in an effort to alleviate concerns about shipyard toxins, Lennar’s limited financial liability, a proposed bridge over Yosemite Slough, and the possibility that local residents will need more access to healthcare and training if they are to truly benefit from the development plan.

Sup. Ross Mirkarimi told the Guardian that he expects the board will require liquidated damages to ensure the city has some redress if the developer fails to deliver on a historic community benefits agreement that labor groups signed when Lennar was trying to shore up community support for Proposition G, the conceptual project plan voters approved in June 2008.

Mirkarimi said the board would also seek to increase workforce development benefits. "Thirty percent of the target workforce population are ex offenders. So while they might get training, currently they won’t get jobs other than construction," Mirkarimi observed.

He supports the health care access amendment and the public power amendment Chiu introduced July 21, pointing to Mirkarimi’s previous ordinance laying the groundwork for public power in the area. "This ordinance established that where feasible, the City shall be the electricity provider for new City developments, including military bases and development projects," Mirkarimi said. "PG&E was ripped when we pushed that through."

But Sierra Club activist Arthur Feinstein isn’t sure if additional amendments will help, given intense lobbying by city officials and a developer intent on winning project approvals this summer before a new board and mayor are elected this fall.

"Chiu’s amendments gave us what we asked for over Parcel E-2" Feinstein said, referring to a severely contaminated section of the shipyard for which Chiu wants an amendment calling for a board hearing on whether it’s clean enough to be accepted by the city and developed on.

But Feinstein is less than happy with Chiu’s Yosemite Slough amendment, which would limit a proposed bridge over it to a width of 41 feet and only allow bike, pedestrian, and transit use unless the 49ers elect to build a new stadium on the shipyard. In that case, the project would include a wider bridge to accommodate game-day traffic.

"The average lane size is 14 feet, so that’s a three-lane bridge. So it’s still pretty big. And it would end up filling almost an acre of the bay," Feinstein said.

Feinstein thanked Mirkarimi and Campos for asking questions that showed that the argument for the bridge has not been made. "But it’s disappointing that a progressive Board would be willing to fill the Bay for no reason," Feinstein said.

He concurred with the testimony of Louisiana-based environmental scientist Wilma Subra and environmental and human rights activist Monique Harden, who challenged the wisdom of the Navy digging out toxins while the developer installs infrastructure at the same site.

Subra said contamination is often found at Superfund sites after they have been declared clean when contractors to later dig into capped sites and expose workers and the community to contamination. Harden said the plan to begin construction on some shipyard parcels while the Navy removes radiological-contamination from shipyard sewers is "like a person jumping up and down on a bed that another person is trying to make."

But Cohen, who has aggressively pushed the project on Newsom’s behalf, countered that there is no scientific evidence to support such concerns. "It’s a very common situation," Cohen said. "It’s the basis for shipyard artists and the police being on the site for many years … It’s safe based on an extraordinary amount of data."

But Feinstein pointed to his experience working for the Golden Gate Audubon Society at the former Alameda Naval Station. He recalls how a remediation study was completed, but then an oil spill occurred at the site, which had been designated as a wildlife refuge.

"The military didn’t know about everything that happened and was stored on site, and it’s easy to miss a hot spot," he said. "And who’ll be monitoring when all these homes are built with deeds that restrict the renters and owners from digging in their backyards?"

Feinstein said he’s concerned that only Campos seemed to be asking questions and making specific requests for information around the proposed project’s financing

"Lennar is paying city staff and consultants and promising labor huge numbers of jobs. When you are throwing that much money around, it’s hard for people to resist — and the city has been co-opted," Feinstein said. "And how much analysis and resistance can you expect from city commissions when the Mayor’s Office is the driving force behind the project? So we don’t have a stringent review. The weakness of the strategy of ignoring our bridge concerns is that when we sue, we may raise a whole bunch of issues."

Arc Ecology director Saul Bloom says Chiu’s bridge proposal "screwed up the dialogue. We were close to a deal," Bloom claims. "But while that amendment allowed one board member to showboat, it prevented the problem from being solved."

Bloom is concerned that under the financing deal, the project won’t make any money for at least 15 years and will be vulnerable to penalties and bumps in the market — an equation that could lead the developer to build only market rate housing at the site.

"It’s a problematic analysis at best," he said.

"The bigger the development, the more it benefits people who have the capacity to address it — and that’s not the community," Bloom said. "So there’ll be more discussion of the bridge, and that’s where the horse-trading is going to be."

He also said the bridge has now taken on a symbolic value. "The thing about the bridge is that it’s not actually about the bridge any more," Bloom added. "It’s about Lennar telling people, ‘You will support us.’ If they get the bridge, it will give them free rein, an unencumbered capacity to do as they see fit. They are willing to make deals, but they have to have the bridge because it defeats the people who have been the most credible and visible — and then they have no opposition."

Board accepts EIR, but vows to amend Candlestick-Shipyard plan

At the end of a ten-hour hearing to appeal the final environmental impact report  for the city and Lennar’s massive Candlestick-Shipyard redevelopment project, the Board voted 8-3 to accept the FEIR, with only Sups. John Avalos, Chris Daly and Eric Mar voting to reverse certification of what they said was a flawed document.


But the vote does not mean the Board has voted to accept the city and the developer’s final redevelopment plan. That plan will come before the Board on July 27, and the supervisors are expected to introduce a slew of amendments, in addition to  five amendments that Board President David Chiu introduced earlier this week.


These amendments are intended to address longstanding concerns about toxins at the shipyard, limited liability on the part of the developer, the questionable need for a bridge over Yosemite Slough, the reality that Bayview residents may be cut out of any upcoming jobs, and the desire to nail down efforts to use public power at the site


“We can’t do the amendments here, we are frozen out, all we can do is an up and down vote on the EIR for now,” Sup. Ross Mirkarimi told the Guardian last night. 
Mirkarimi anticipates that the Board will seek additional mitigations, such as requiring liquidated damages to shore up a community benefits agreement that Labor entered into with Lennar in May 2008.


Mirkarimi said the Board would also seek to increase workforce development benefits.
“Thirty percent of the target workforce population are ex-offenders, so while they might get training, currently they won’t get jobs other than construction,” Mirkarimi observed.


Mirkarimi was proud of the Public Power amendment that Chiu has already lintroduced, pointing to an ordinance that he and then Sup. Gerardo Sandoval introduced and Mayor Gavin Newsom signed into law, in March 2006. This public power ordinance established that “where feasible, the City shall be the electricity provider for new City developments, including military bases and development projects.”


“PG& E was ripped when we pushed that through,” Mirkarimi said.


During yesterday’s marathon hearing, the supervisors grilled city staff on issues that have proved to be key sticking points, as the city seeks to win final project approvals, even though they cannot address these issues with amendments until the July 27 meeting.


The Board questioned the wisdom of moving forward with development on the Shipyard, as the Navy continues to clean up radiological contamination and other toxins at the site, including Parcel E-2, which contains some of the nastiest pollution at the yard.


“Why not just wait until the CERCLA process is completed?” Sup. Campos asked, referring to the fact that the Navy is responsible for shipyard clean up, under CERCLA, which is also known as the Superfund Act.


Campos question came after acclaimed environmental scientist Wilma Subra and national environmental human rights lawyer Monique Harden, challenged the sanity of having the Navy digging out toxins while a developer simultaneously installs infrastructure at the same site.


Subra, who works in Superfund sites throughout the U.S, warned the Board that it’s very common to find contamination at these sites after they have been declared clean.


“So, the number of samples isn’t the magic answer,” Subra said, referring to the city’s constant refrain that the Navy has taken thousands of samples at the site. Subra also warned that it is not uncommon for a contractor to dig into an area that has been capped, thereby potentially exposing workers and the community to contamination and resulting in legal stand-offs, as various parties argue as to who has responsibility to fix the resulting mess.


Harden, who is based in New Orleans but also has an office in D.C., expressed concern over the plan to begin construction on some shipyard parcels, even as the Navy continues to remove radiologically contaminated sewers and other deep infrastructure at the site.
“That’s like a person jumping up and down on a bed that another person is trying to make up,” Harden said


But Michael Cohen, Mayor Gavin Newsom’s chief economic advisor countered that there was no scientific evidence to support Subra or Harden’s concerns.


“It’s a very common situation, especially on brownfields,” Cohen said, (though the Shipyard is a Superfund site that’s been contaminated with radiological waste that was sandblasted off ships returning from a Bikini Atoll atomic testing experiment gone awry.)


“It’s the basis for shipyard artists and the police being on the site for many years,” Cohen continued. “It’s safe based on an extraordinary amount of data.”


But Cohen did agree that language in Chiu’s Parcel E-2 amendment should be changed from “should” to “shall” to indicate that city oversight is a requirement, not a request, when it comes to final decisions over the transfer of this particular parcel.


Mark Ripperda of U.S. EPA assured the Board that his agency is not going to permit transfer of parcels for development until cleanup is completed.
“We are not going to allow any transfer until we are convinced it’s safe,” Ripperda said.


Sup. Eric Mar chastised the EIR for its apparent failure to adequately discuss the impacts of the proposed development on schools in the surrounding area.


“There is less discussion of the impacts on schools than there is of the A-Bomb, which was held at the Shipyard for 1 to 2 days,” Mar said. “The analysis seems very weak.”


And Daly expressed frustration that the Board was being asked to take a decision when it lacked sufficient information about and understanding of the project.


“How do we know it’s safe? ” Daly asked, noting that, “Money talks, bullshit walks.”
(His point resonated as City staff scrambled to find key information within the 7,000 pages of comments and responses in the massive FEIR documents, and Amy Brownell of the city’s Public Health Department rattled off a series of measurements and schedules that few on the Board seemed to understand.)


“The risks are acceptable,” Brownell said. “And the only people allowed on the property [during the development] will be the ones doing the work.”


The Board also challenged the need for a bridge over the environmentally sensitive Yosemite Slough, especially in the wake of the June 2010 election in which Santa Clara voters approved building a new stadium for the 49ers near Great America.


“One reason I’ve been given for [the need for the bridge] is the financial viability of this project,” Campos said.


Cohen replied that if the city does not to build the bridge, “it elevates the financial risk.”


“Parcel C [on the shipyard] has been zoned for green tech, and for major employers, having that direct connectedness to BART and the T-Third is very important.”


Cohen also indicated that, thanks to the project’s huge reliance on tax increment financing, the loss of the bridge would translate into lost property tax revenues.


“Some of the repayment comes from generation of tax increment financing, so the failure to have a bridge here, degrades the potential of property tax revenues, and so you get much less tax increment,” Cohen stated.


The Board also expressed concerned that under the current terms of the deal they are now set to consider July 27, the developer has limited liability—an arrangement that has got supervisors worried that the city, and Bayview residents whose increased property taxes will help pay for the development, could end up on the wrong end of the financial hook.


Campos pointed to the disposition and development agreement (DDA) that the city drew up with Lennar.
“I’m specifically worried about a provision that on the face of it limits the developer’s liability,” Campos said, pointing to language that seems to say that “monetary damages are inappropriate”—conditions that Campos deemed, “Very unusual.


Cohen responded that the deal reflects the reality that, “the Navy, not Lennar is responsible for the cleanup.”
He added that the city retains the legal ability to sue, various remedies and, ultimately, “the right of reverter” (which folks call the “nuclear option” since it involves kicking out the developer, but losing everything in the process.)


“This is an incredibly frontloaded project,  in which we have the ability to terminate the developer at the cost of millions of dollars,” Cohen said.


But while the city and the developer ultimately affirm EIR certification, the decision left the Bayview community deeply divided, with many concerned that the FEIR failed to address their concerns, while others rejoiced, believing that they will benefit from jobs that will be created during the development’s 10-15 year build out and beyond. Only time will tell how it all plays out, but stay tuned as the Board prepares to try and make the plan the best it can in face of all these competing concerns.


 

Board votes on Candlestick-Shipyard project EIR appeal today

The Chronicle’s suggestion that the city’s massive Candlestick-shipyard project may be facing smoother sailing seems like wishful thinking to those who attended a July 12 noontime rally that was organized by POWER (People Organized to Win Employment Rights) and featured two Louisiana-based advocates who protested the project’s EIR and shared many of the longstanding concerns about project cleanup, infrastructure and financing.

The Chronicle was of course referring to five amendments to the city’s massive redevelopment proposal that Board President David Chiu introduced during yesterday’s July 12 meeting of the Board’s Land Use committee. The Chron interpreted these amendments as a sign that Chiu plans to approve the project’s environmental impact report, which comes before the Board today, after several groups appealed the final EIR that the Planning Commission approved last month.

But while city officials fear the developer will walk, if the Board does not approve the final EIR, some environmental advocates hope a better plan could be reached.

At POWER’s July 12 rally, nationally acclaimed environmental scientist Wilma Subra called on the District Attorney’s environmental justice department to “step up.” Subra claimed that the project’s final EIR “failed to evaluate and assess the cumulative impacts of exposure to children, adults and the environment as a result of exposure to all of the chemicals at the site.”

Monique Harden, co-director and attorney for Advocates for Environmental Health Rights (AEHR) of New Orleans, Louisiana, pointed to “deep flaws in the environmental regulation system,” as a reason why low-income communities of color should be concerned about the proposed plan.
“Why in the middle of an environmental crisis caused by BP in the Gulf am I coming to San Francisco?” Harden asked. “Because San Francisco is providing unequal environmental protection to its residents. As a resident of New Orleans, I’m concerned that San Francisco is careening towards making a decision that can crush the future of Bayview Hunters Point,”

But as local Bayview resident Jose Luis Pavon began talking about seeing gentrification occur in his lifetime within San Francisco, he and others got shouted down by a group of yellow and green-shirted project supporters, who were led by a guy calling himself Bradley Bradley and Alice Griffith public housing resident Stormy Henry.
“This is the devil’s trick in the last hour,” Henry said of the POWER rally.

Henry shared her heartfelt belief that if the Board approves the project’s final EIR, she and other Alice Griffith residents will get desperately needed new housing units. even if it takes some years to build them. Others in her group were unable to answer media questions: they had difficulty speaking in English, but were clutching neatly written statements in support of the project that they later read aloud at the Board’s Land Use Committee hearing.

As these project supporters prepared to move inside to attend the Land Use Committee meeting and lobby supervisors for their suppor, D. 10 candidate Tony Kelly shared his concerns that the Navy has a demonstrated history of finding nasty things at the shipyard years after they say everything’s clean, and that this pattern could jeopardize the plan.

“This happened at Parcel A,” Kelly said, referring to the first and only parcel of land that the Navy transferred to the city for development in 2004. “Since then, Parcel A has gotten smaller and as they found stuff on sites they then renamed as new parcels, like UC-3, which has radiological contamination in a sewer line that goes into the Bayview. So, that means the contamination is now in the Bayview.”

Kelly is concerned that the city is trying push through EIR certification before the Navy completes an environmental impact statement (EIS) related to shipyard cleanup activities. “The EIS is supposed to go before the EIR, as far as I know,” Kelly said

At the Land Use Committee meeting, Sup. Sophie Maxwell, whose district includes Candlestick and the Shipyard,said, the project was about “revitalization and opportunity.”

She noted that the certification of the project’s final EIR has been appealed to full Board’s July 13 meeting. She further noted that she intends to introduce legislation next week to address concerns that Ohlone groups have expressed.

The next two hours were full of testimony from a bevy of city officials, beginning with Michael Cohen, Mayor Gavin Newsom’s top economic advisor in the Office of Workforce and Economic Development.

“Every single element [of this project] has been discussed and debated at countless meetings,” Cohen claimed, as he sought to quell fears that the community had not been properly consulted with over the plan. “As we get closer to a vote, all of a sudden pieces of paper start circulating, criticizing project and suggesting that community involvement just began,” he continued. ” That’s factually untrue.”

He also sought to reassure the supervisors that the Board will have a say-so as to whether the city accepts early transfer of shipyard parcels from the Navy.
“Neither the city nor the developer have any specific authority over the cleanup,” Cohen said, noting that the cleanup is governed by specific rules set out in CERCLA [Comprehensice Environmental Response, Compensation and Liability Act, aka Superfund].

“Regardless of what we do, CERCLA will continue to be the regulatory tool,” Cohen said. ” I urge you not to be confused by CEQA and CERCLA.”

So, how can the city implement Prop. P, which voters overwhelmingly supported in 2000, urging the Navy to clean up the shipyard to highest attainable standards.
“Prior to any transfer, US EPA and DTSR have to concur in writing that the shipyard is safe,” Cohen explained, noting that, thanks to Speaker of the House Nancy Pelosi, the Navy has already spent over $700 million on shipyard cleanup efforts.

“We have 250 artists at the shipyard….but not a shred of scientific evidence to say that the shipyard is not safe,” Cohen claimed. “It’s safe to develop the shipyard in precisely the manner we are proposing.”

When Sup. Eric Mar raised the question of radiological contamination on Parcel UC-3, Cohen downplayed Mar’s concerns.
“The exposure levels are lower than watching TV,” Cohen claimed. “The primary source is very low level radiation from glow-in-the-dark dials.”
Indicating a map that showed a network of old sewers (in blue) and old fuel lines (in red) under the entire development area, Cohen said, “The radiological contamination that has and will be addressed at the shipyard is quite low level. You have radiation, you get nervous. We asked EPA to come out and do a scan to deal with the issue.”

IBI Group’s David Thom, the lead architect and planner for the project said the plan is designed “to connect new development back into the Bayview.”
“And this plan connects the Bayview through to the water.”

Tiffany Bohee, Cohen’s deputy in the Mayor’s Office of Economic and Workforce Development, insisted that project’s proposed bridge is better than Arc Ecology’s proposed alternative route, which would not involve constructing a bridge over an environmentally sensitive slough.
“The non-bridge route increases the number of intersections,” Bohee said, seeking to turn an environmental question (the impact of bridge on wildlife and nature experience) into a public safety issue.”
She claimed the BRT route over bridge was 5-10 minutes faster than Arc’s proposed alternative, “because there are fewer turns, it can go at higher speeds.” But Arc’s studies suggest the BRT route over the bridge is only a minute faster, and would cost over $100 million.

Bohee noted that $50 million from the sale of 23 acres of parkland for condos at the Candlestick Point State Recreation Area (CPSRA) will be “set aside for the state, and won’t be able to be raided by the city,” with $40 million going to improvements, and $10 million to ongoing operation and maintenance costs.

She also cited additional benefits that the project would bring to the community, including thousands of construction job opportunities.

“We are working with City Build to make sure they are for local residents,” Bohee said.“And there is absolutely no displacement for the rebuild,” Bohee continued referring to proposal to place current Alice Griffith public housing iresidents n new units, on a 1-1 basis

Eric Mar said he was impressed by many elements of the plan, but continued to express reservations.
“I’m still concerned that is seems to serve newcomers as proposed to existing residents,” he said. “And I’m still not convinced that the bridge is the best for existing residents.”

Rhonda Simmons, who works in Cohen’s Office of Economic and Workforce Development,  tried to flesh out details of the project’s job creation promises.
“The most immediate workforce is related to the construction site, and as you know, this project goes over a 15-20 year span,” Simmons said, pointing to green tech and retail as job opportunities that will exist once the project is built.

Mar expressed concern that the jobs may not be at the level of D.10 residents
“How is this gonna bring their skill level up?” he asked.
“The idea is that training gives first level entry at a variety of building trades,” Simmons said, pointing to the project’s large solar component.

“What about women?” Sup. Maxwell asked
Simmons pointed to retail opportunities,
“The idea of the training is to give folks job readiness skills, like getting there and showing up on time,” she said

Mar wanted to know who would have oversight of monitoring and compliance.
“In the city we have a tapestry of folks who do contract compliance,” she said. “The oversight will come from a variety of places.”

After Kurt Fuchs of the Controller’s Office listed the estimated economic benefits of the project, Board President David Chiu observed that the city is “at a crossroads.”

“I do not plan to prejudge,” Chiu continued, as he introduced his five amendments to regulate the Parcel E-2 cleanup, the size of a proposed bridge over the Yosemite Slough, expand healthcare access in the Bayview, create a workforce development fund and lay the groundwork for bringing public power to the project.

During public comment, Bayview resident Fred Naranjo pleaded for project support.  

“Please don’t let the train leave the station,” Naranjo said. “If Lennar leaves, the Bayview will never be developed.”

And Tim Paulson, executive director of the San Francisco Labor Council expressed hope that an agreement was getting closer.
“There really is a path to getting this done,” Paulson said. “This really is a model project in many ways for the rest of the United States.”
But D. 10 resident Linda Shaffer with the Yerba Buena chapter of the California Native Plant society indicated the huge pressure exerted on folks to support the project
“I do not want to be classified as an opponent, but we have concerns,” Shaffer said, noting that her group has filed an appeal of the project’s final EIR.

And while the Sierra Club’s Arthur Feinstein thanked Chiu for proposing to reduce the size of the bridge, he pointed out that Chiu’s amendment wasn’t really a compromise.
“That’s because it’s still a bridge,” Feinstein said, as he explained how noisy the area surrounding the slough will become as traffic whizzes by.

“The neighborhood is changing,” she said. “Since 1990, African American families have been leaving the Bayview in huge numbers. I encourage you to see this project as a good plan.”

Gabe Metcalfe of SPUR expressed his unconditional support for the plan,
“This plan is being asked to fix a huge number of problems,” he said.
Noting that the bridge continues to be a sticking point, Metcalfe said he sees opposition to every transportation project these days.
“We seem to be in a moment when you can’t build anything without it being opposed.”

But other speakers from the Sierra Club reiterated their stance that there are better and viable options to the bridge, noting that it is too costly, and that the surrounding community and wildlife would be better off without it.”

All these competing viewpoints suggest that whatever decision the Board makes today, it will take some time and create plenty of uproar. So, here’s hoping the Board votes in a way that will truly benefit the D. 10 community, not career politicians, city officials and out-of-state developers. It’s about time.

Transit troubles

Peggy da Silva is an avid cyclist, public transit advocate, and member of the San Francisco Transit Riders Union — a new organization made up of several hundred San Franciscans who want to see improvements to Muni.

Yet even she admits that when it comes to getting to work, it takes just 15 minutes by car or an hour if she opts to go by bus. “I am committed to transit and cycling” for environmental reasons, she said, but “it gets really frustrating” to wait for the bus or light rail cars to arrive.

Da Silva could be considered lucky in that she can opt to drive if she feels it’s necessary, while many lower-income San Franciscans cannot afford a car and have no choice but to rely on Muni to get to work, buy groceries, or make doctor appointments. It’s even worse late at night when the buses run less frequently and the streets are dark and empty.

Speaking at a June 29 transit rally, the Rev. Norman Fong of the Chinatown Community Development Center joked that Chinatown is one of the city’s greenest neighborhoods — but “not by choice.” Most Chinatown residents just can’t afford to own a car, underscoring the point that Muni service cuts affect lower-income communities more significantly than those with more transportation options.

The perception that Muni is broken isn’t unique to transit advocates. Around City Hall, a number of proposals have been put forth to fix the ailing system, which has been mired in delays and overcrowding as fares have gone up and service was slashed. But determining what the root problems are, how they should be addressed, and what the best path forward may be has proved arduous.

Rather than a simple calculation or a study in efficiency, the debate surrounding Muni is spinning into an emotionally charged affair. For those aiming to protect low-income riders from service cuts or fare increases, it’s a discussion about social justice, calling into question why the city is asking more of bus riders than motorists in a city with a “transit-first” mandate in its charter.

The strong opposition to the cuts by supervisors and the public has led to a rollback. On June 30, the San Francisco Municipal Transportation Agency (SFMTA) announced that on Sept. 4, it would be able to restore half of the 10 percent systemwide service reduction that went into effect in May.

“Due to stronger than expected revenue streams, operational efficiencies, and new grant opportunities, staff is recommending the restoration of service on some routes and lines this fall,” according to an SFMTA press release. Buses that run all night would come more often, and the partial service restoration would help ease over-crowding.

While this was welcome news for anyone who takes transit, the expected improvement still leaves untouched many key issues plaguing the city’s public transit system. Two separate initiatives most likely destined for the November ballot seek to deal with systemic problems — but both have met with resistance.

On July 1, Sup. Sean Elsbernd announced that he had submitted some 75,000 signatures for a proposed charter amendment for the November ballot to change the way transit operator salaries are determined. Since they only needed 46,000 signatures, “presumably, we’ll qualify,” Elsbernd told us.

“It presses the reset button on all the [memorandums of understanding] and then puts the riders at the table,” he explained. “It also eliminates the side letters that allow the six leaders of the union to get full-time salaries and benefits without needing to drive.”

Elsbernd’s proposal would require operator wages and benefits to be set through collective bargaining, instead of the current guarantee that their wages be at least as high as the average wage rate for transit operators in the two highest paying comparable transit systems.

Yet his proposal is opposed by the city’s transit operators union, TWU Local 250-A, whose members feel they’ve been unfairly blamed for the MTA’s fiscal problems. Speaking at the June 29 rally, Ron Heintzman, the new international president of the Amalgamated Transit Union, summed up the attitude of drivers who feel they are being asked to give up hard-fought gains in the face of an economic downturn.

“I’ve been told that here in San Francisco, the mayor for some reason clearly has his head up his ass,” Heintzman said. “It’s time to tell him to stop trying to balance the damn budget on the backs of the workers.”

Speakers at the rally voiced support for federal legislation that would bolster municipal transit budgets nationwide with a $2 billion emergency infusion. A second federal bill would allow local governments greater flexibility with federal transit funding that currently can only be spent on capital projects, not day-to-day operations.

“We’re asking them not to make us buy a bus when we can’t hire a bus operator to drive it,” explained Harry Lombardo, international president of the Transit Workers Union. “There’s no point in spending hundreds of thousands on a bus and letting it sit in mothballs. And believe me, it’s happening all over the country.”

Sup. David Campos, a cosponsor of a competing ballot measure that aims for more comprehensive Muni reform, joined the rally and criticized the notion that drivers should be blamed a dysfunctional, underfunded transit system.

“Those of you who live in San Francisco know that right now there is a climate at City Hall that is pointing the finger at drivers, blaming drivers and blaming the workers for the problems that this system has,” Campos said at the rally. “Muni is broken. But Muni is not broken because of labor. And we have to say no to that push to somehow create a division between riders and drivers…. We can’t ignore the fact that we have a system that is getting money that is not being used well.”

Campos has joined with Sups. Ross Mirkarimi, Eric Mar, and Board President David Chiu to propose a reform package that would remove the pay guarantee for Muni driver, but also create split appointments to the MTA Board of Directors, allocate a share of property tax revenue to the city’s Transportation Fund, and establish an Office of the MTA Inspector General to help reduce waste and ramp up efficiency. The proposal would be subject to voter approval in November.

The proposal to give the supervisors some appointments to an MTA board that is now solely accountable to the Mayor’s Office became an issue at the eleventh hour of budget negotiations between the supervisors and Newsom on June 30. The mayor strongly opposed that and two similar charter amendments that would establish split appointments for the Recreation and Park Commission and the San Francisco Rent Board, as well as a ballot measure that would require the police department to engage in foot beat patrols.

Many saw his stance as a quid pro quo that inappropriately tied mayoral support for the budget — which included funding restorations to community programs that progressive board members wanted to preserve — to these unrelated ballot proposals.

Dave Snyder, who directs the SF Transit Riders Union, viewed the move as an affront on Muni riders. “This particular mayor has managed to screw up Muni service through his complete control over the agency,” Snyder said. “And whatever it takes, Muni riders want to see that fixed.”

While he said he thought a split appointment for the MTA Board was important, “the most important thing is more money. That’s the key issue,” he added, noting the reform package would create more funding for Muni.

Members of the Budget and Finance Committee resisted the mayor’s demand and forwarded a budget to the full board that included their high-priority restorations. The proposed ballot measures will be considered by the board this month.

“If you ask me, I would say we should have commission reform across the board,” Mirkarimi told the Guardian. “The idea of having [equally balanced appointments] is a smart way for us to share the responsibility and the consequences.”

MTA’s fiscal problems aren’t unique to San Francisco. On July 1, Caltrain announced a menu of undesirable options to deal with big financial troubles facing the commuter railroad. Elimination of weekend service and certain weekday train stops, or a 25-cent increase to base fares or zone fares, will be the subject of public hearings this summer.

Noting that all the different sources that fund Caltrain have been slashed, spokesperson Christine Dunn told us, “It’s frustrating to not be able to provide the service you want to provide.”

Lennar’s litmus test

None of the many stakeholders tracking the progress of Lennar Corp.’s massive Candlestick Point-Hunters Point Shipyard redevelopment plan registered surprise when the Board of Supervisors received three appeals to the Planning Commission’s June 3 certification of the project’s final environmental impact report (FEIR).

Instead, everybody who has been watching the political juggernaut that has been pushing for quick approval of the project over the past month said they anticipated that the FEIR would be appealed, and perhaps litigated. But the real question is whether the project will be substantially changed.

In the seven months since the project’s draft EIR was released, the Planning and Redevelopment Commissions have repeatedly rejected all arguments and recommendations made by its critics to improve or delay the plan, rushing the approval along on a tight schedule (“The Candlestick Farce,” 12/21/09).

The rush job occurred even as numerous groups and individuals warned that the DEIR comment period was too short, (“DEIR in the headlights,” 02/03/10) and complained that the city and the developer had dismissed crucial data and testimony while exploiting fears the San Francisco 49ers would leave town if the city didn’t act quickly (“Political juggernaut,” 06/02/10).

What’s less clear is whether the Board of Supervisors has the political will to heed these appeals and correct what opponents say are serious flaws in the city’s FEIR. The appeal that the Sierra Club, Golden Gate Audubon Society, California Native Plant Society, and San Francisco Tomorrow filed June 21 lists nine deficiencies.

These included the FEIR’s failure to look into an alternate Bus Rapid Transit (BRT) route around Yosemite Slough or adequately assess impacts resulting from the landfill cap on Parcel E2 and the transfer of 20 acres of public shoreline land in Candlestick Point State Recreation Area (CPSRA) to build high-end housing.

“The FEIR failed to analyze those elements of the project’s sustainability plan that could have significant environmental impacts, including two proposed heating and cooling plants (which appear to be power plants) to serve 10,500 housing units and a projectwide recycling collection system,” the coalition further charged.

The appeal also voiced concern that the FEIR failed to adequately assess impacts resulting from the construction and maintenance of the development’s underground utility matrix, impacts to the bird-nesting in the proposed 34-acre wetland restoration project at the state park, and delays to eight Muni lines.

But the Sierra Club-led coalition also indicated that by removing provisions for a bridge over Yosemite Slough, transfer of land in the state park, and compromised clean-up efforts at Parcel E2, resolution of many of these disputed issues could be expedited.

“If the Board of Supervisors acts promptly, revisions to the EIR may be made quickly and result in a minimal delay in the progress of the project,” the coalition stated.

The Sierra Club’s Arthur Feinstein told the Guardian that the coalition’s top three concerns are “very important, but the six other issues are also very real.”

“Here we have a city cutting 10 percent of its bus service while saying that eight bus routes will need to be improved because of the project, and admitting that the development will increase air pollution in a district that has the highest rates of asthma and cancer without identifying mitigations such as reducing parking spaces in the proposal,” Feinstein said.

POWER (People Organized to Win Employment Rights) also filed an FEIR appeal June 21 listing a broader range of environmental and economic justice-related concerns.

These included the FEIR’s failure to analyze and mitigate for displacement that would be triggered in the surrounding neighborhood by developing 10,500 mostly market-rate housing units in the area and “failure to provide for adequate oversight and enforcement of the terms of the early transfer” of the shipyard from the Navy.

POWER also cited the FEIR’s failure to adequately mitigate against the impact of sea level rise, the risks associated with potential liquefaction of contaminated landfill at the shipyard in the event of an earthquake, and health risks related to chemicals of concern at the shipyard. The group also faulted the city’s failure to get the Navy to prepare an environmental impact statement on its clean-up plan before the FEIR was completed.

Finally, Californians for Renewable Energy (CARE) filed a five-point appeal June 23 charging that the project contravened the intent of Proposition P (which voters approved in 2000, urging the Navy to remediate shipyard pollution to the maximum extent possible), that the project’s FEIR is incomplete because the Navy (which still retains jurisdiction over the project lands) has not yet completed its EIS, and that the FEIR approval process was tainted by 49ers-related political pressure.

“The pre-set goal of maintaining the 49ers in San Francisco has colored the environmental analysis of this decision,” CARE noted, referring to the city’s rush to get the project’s FEIR certified on June 3 — five days before Santa Clara County voters approved a new stadium for the 49ers near Great America .

The appeal filings mean the Board of Supervisors is required to hold a hearing within 30 days, a move that places a roadblock, at least temporarily, in the way of the city’s tight schedule to secure final approvals for Lennar’s megaproject before summer’s end.

Board President David Chiu told the Guardian that the Board’s Land Use Committee will move forward with a July 13 meeting to hear a list of proposed amendments related to the underlying plan along with the FEIR appeals.

“We are back at the board Land Use Committee July 12 with 10 items related to the project,” said Chiu, who is a member of the Land Use Committee. The three-member committee is chaired by Sup. Sophie Maxwell, who represents the project’s District 10; Sup. Eric Mar is vice-chair.

“The next day, July 13, has been tentatively set for a full meeting of the full board,” Chiu continued. He acknowledged that the FEIR related materials are dense and complex, telling us that “they form the largest pile on my desk, and it’s about five inches high.”

But he wasn’t about to prejudge the outcome. “We do need to clean up the area and rebuild it in such a way that it will dramatically increase affordable housing and jobs and support a livable diverse community,” Chiu said. “Obviously there are still a lot of questions and concerns about the proposed project and the board will push to make sure all these issues are adequately addressed.”

CARE president Michael Boyd said he hoped the board would take his group’s appeal seriously and fix the plan’s fundamental shortcomings. “That means going back to square one,” he said.

But others were less sure that the board would seek to overturn the entire plan. “Everyone in the community would like the best level of clean-up,” said Saul Bloom, whose nonprofit Arc Ecology has tracked the proposed shipyard clean-up for three decades. “But what’s possible and practical? And will the city be supportive of that or the most expeditious solution?”

Bloom reserved gravest concern for plans to cap, not remove, the contaminants from the shipyard’s Parcel E2. “The concern is that if you put a cap on E2 without a liner then contaminants could scootch out during a seismic event, or over time, and cause problems because of the parcel’s close proximity to surrounding groundwater and the San Francisco Bay,” he said. “But to place a liner in there is very expensive because you’d have to excavate E2, at which point you might as well replace it with clean soil.”

Bloom acknowledged that the Navy has argued that excavation would cause a nasty smell and nobody knows what is going to be released in the process.

“But long-term Bayview residents like Espanola Jackson have made the point that the community already lives within nose-shot of the southeast sewage treatment plant and would rather put up with a few years of nasty smells, given the relative benefits of cleaning the yard up,” he said. “And how do we know a cap will be protective given the Navy’s argument that we don’t know what’s down there?

“The thing that makes the most sense here is to clean up the shipyard to the best possible extent, but the city isn’t planning to do that,” Bloom added. “And the environmental community’s bottom line has always been the bridge [over Yosemite Slough, which the Sierra Club opposes]. So the sense is that if the bridge goes away, so does their problem.”

Following Recology’s $$$ to Environment Commission and DCCC

If you’ve been looking for a financial connection between the city’s tentative decision to award the next landfill disposal contract to Recology, which plans to dispose of our trash in Yuba County, then you’ll be interested in this campaign finance item: Because records show that Recology contributed $5,000 last year to SF Forward, a San Francisco Chamber of Commerce political action committee, which also got Money  from Bechtel, Medjool, PG&E, Charles Schwab, and Shorenstein Realty.

Recology Vice President and Group Manager John Legnitto is Chamber’s Chair Elect.

In the last two years, the Chamber contributed $10,000 to Plan C, a political action committee that advocates for more condo conversions and less tenants’ rights.And Plan C gave Commission of the Environment President Matt Tuchow $3,300 for his failed 2010 Democratic CCC bid.

So, while the transactions were legal, with the money laundered twice in between, these dollar connections will probably have folks opposed to the city’s plan to dispose of its waste in Recology’s landfill in Yuba County asking if this explains why Tuchow decided to limit public comment to only one minute when folks wanted to voice concerns at a March 23 hearing at the Environment Commission about an alleged lack of fairness and transparency in the decision to award the contract to Recology.

Especially those folks who drove three hours from Yuba County, which is where Recology proposes to send our trash. And folks who helped negotiate the city’s current trash disposal contract and were shocked that the city would set a one-minute time limit on what they claim is a $1 billion contract, once you factor in the cost of transportation, new trash processing facilities and an as yet unbuilt rail spur that Recology needs inYuba County to transfer trash from the Union Pacific line to its landfill in Wheatland,

Tuchow, who works in the Global Compliance and Ethics Division of McKesson Corporation in San Francisco, had not returned calls as of blog post  time, but if and when he does, I’ll be sure to post an update here.

Meanwhile, it doesn’t look as if Recology’s bucks and/or Mayor Gavin Newsom’s powergrabbing antics, are going to be able to help shoehorn Tuchow onto the DCCC, even in light of Newsom’s newly hatched plan for dominion for the following reasons:

1. Results from the June 8 election show that Tuchow was fourth failed runner up in the DCCC 12th district. (Milton Marks, Sup. Eric Mar, Melanie Nutter, Arlo Smith, Connie O’Connor, Tom A. Hsieh, Jane Morrison, Mary Jung, Sandra Lee Fewer, Michael Bornstein, Sup. John Avalos and Bill Fazio were the top vote getters to win seats, beating out Larry Yee, Jake McGoldrick, Hene Kelly and then Tuchow, in that order.)

2.. It’s not clear if Newsom’s plan for the DCCC is even legal.

3. Even if Newsom’s plan survives a legal challenge, it’s not clear that the law would have the retroactive effect necessary to oust Mar and Avalos.

4. And even if it did, under state law,  DCCC Chair Aaron Peskin would get to appoint folks to fill those vacancies,
“This is about clean money and good government,” Newsom spokesman Tony Winnicker told reporters of Newsom’s DCCC plan.

So, let’s hope the Mayor’s Office applies the same standards when it comes to opening the landfill disposal contract bids this summer and shining light on the money that’s influencing the city’s garbage disposal contract. 

Meanwhile, Peskin, who was reached by cell phone somewhere near Moab, in Utah, where he’s taking his annual camping and hiking trip with his wife, told the Guardian that Newsom “is not thinking very far ahead” with his latest dominion scheme.

 

 

Newsom’s plan for DCCC domination

Gavin’s not quite ready to take over the world, or even California, but he’s not leaving office without trying to mess up the progressive majority on the Democratic County Central Committee. The plan he hatched June 15: Ban elected city officials from sitting on the DCCC. The idea: Get rid of Supervisors David Campos, David Chiu, John Avalos and Eric Mar. The overall plan: With the progressive supervisors — who have high name recognition and thus get easily elected — gone, the Newsom allies can take back control of the local Democratic Party.


It’s a pretty blatant move — far beyond Aaron Peskin’s so-called coup. And I must say, it’s a bit hypocritical.


See, the DCCC isn’t just made up of 24 elected members. Every San Francisco Democrat who holds state or national office — or who is a candidate for state or national office — is also an automatic member. So Senator Diane Feinstein is a DCCC member; so is House Speaker Nancy Pelosi, Assemblymember Tom Ammiano and Sen. Mark Leno. And guess who gets a seat this fall? Lt. governor candidate Gavin Newsom. People like Feinstein and Pelosi never show up; at best, they send a proxy. They rarely pay much attention to the local party, don’t help out much with party fundraising, don’t even come to the party’s annual dinner (Newsom didn’t show this year, even though he’s the mayor of a Democratic city.)


There have been members of the Board of Supervisors on the DCCC for years. The late Sue Bierman was always a member, and actually cared about and paid attention to the local Democratic Party. Leslie Katz was a member as a supe, and still is. It’s never been that big a deal to anyone — until the progressives starting winning seats. Then suddenly it’s a horrible conflict.


The real conflict has nothing to do with city officials sitting on the committee; it’s the fundraising issue. The city’s campaign finance rules don’t apply to DCCC races, so candidates for DCCC who are also running for supervisor — Scott Wiener, Rafael Mandelman, Debra Walker — can raise unlimited money for their DCCC races and use that additional name recognition for the fall elections. The thing is, I think most of the candidates who benefit from this loophole agree that it needs to be fixed; Mandelman certainly does, and he’s told me that several times. I couldn’t reach Walker or Wiener this morning, but I’d be very surprised if both of them wouldn’t endorse some kind of contribution limits for DCCC races.


I asked Newsom’s press spokesperson, Tony Winnicker, if the mayor would support fundraising limits. Apparently he doesn’t (or at least, he doesn’t want to push the issue):


“For this November’s local ballot, which the Mayor can place an initiative on, we propose eliminating the potential conflict that exists between City officeholders also holding office as elected County Party Committee members.”


How about getting rid of all the elected officials, and creating a real grassroots county committee? No, that won’t fly with Newsom either. Winnicker:


It’s appropriate for state and federal Democratic elected officials from San Francisco to serve on the Democratic County Central Committee.


The city/local offices — Mayor, Board, Treasurer, Assessor, City Atty, Sheriff, District Atty, Public Defender — are nonpartisan offices who have direct oversight over City business. That’s the difference and conflict. This is a local initiative, so our focus and concern is local good government and local conflicts or appearance of conflicts.


From everything I can figure, Newsom doesn’t want campaign-finance reform and doesn’t want to put the party in the hands of local activists; he just wants to get rid of the supervisors who take positions he doesn’t like. That seems like a pretty bad way to make public policy. 


UPDATE: Just talked to Scott Wiener, who told me he agrees that the whole issue of DCCC campaign spending ought to be on the table. And he said he is not at this point prepared to support Newsom’s initiative. “I have concerns with the number of elected officials on the DCCC,” he said, “but there are times when it’s entirely appropriate to have people who have a demonstrated commitment to the DCCC and then get elected supervisor to stay on it.”

Reading the June election tea leaves

Everyone’s reading the tea leaves after the local election. The November supes races will be a huge deal, and it’s really tempting to try to figure out what the DCCC results mean for the fall. Paul Hogarth at BeyondChron takes it on here. Chris Daly (no surprise) disagrees.


Let me see if I can sort some of this out.


Hogarth’s basic argument is that the progressives didn’t really do so well in the election:


“In District 8, moderate Scott Wiener finished 1,400 votes ahead of progressive Rafael Mandelman – as the two face the same electorate in November. The renters’ financial hardship measure, Proposition F, lost badly citywide – and finished far worse in neighborhoods that are usually pro-tenant. Debra Walker fared well in her run for DCCC, but most of her votes were not in District 6 – and results there suggest that another candidate for Supervisor could make such a race highly competitive.”


Hogarth is completely upfront and honest about disclosing that he’s a supporter of one of Walker’s opponents, Jane Kim — a former Green who is now a Democrat (and is very much a progressive), but wasn’t in the DCCC race. Theresa Sparks wasn’t in the DCCC race either. Nor was Jim Meko. There are several strong candidates in that race, and they don’t break down along easy political lines. So looking at how many votes Walker got in D6 seems a little off point; there’s nobody to compare her to.


Back to D8. Hogarth:


“Now we know [the D8 breakdown], and the numbers are even worse for Mandelman. Scott Wiener finished approximately 1,400 votes ahead in District 8 (my vote count shows him at 5,954 to Mandelman’s 4,561.) As a comparison, in December 2002 – the last time District 8 saw a hotly contested race on “moderate v. progressive” lines – Bevan Dufty got 11,000 votes, Eileen Hansen 10,000.”


That would seem to make Wiener the much stronger candidate going into the fall.


But there’s another key factor here: turnout. Low-turnout races are mostly (not always, but mostly) better for the more conservative candidate, and in this case, the turnout was really low. Just 32 percent of the voters went to the polls.


Let’s take a look at the 2002 election, the last time we had an open seat in D 8 with a progressive and a moderate running. In the general election in November, progressive Eileen Hansen came in first, with 9,820 votes to Bevan Dufty’s 8,795. But another progressive, Tom Radulovich was also in the race, and this was before ranked-choice voting. Radulovich got 5,221 votes, the majority of which probably would have gone to Hansen.


Turnout was a little over 50 percent.


In the runoff, in December, turnout dropped to 38.8 percent. Dufty got 11,096 votes, and Hansen 9,995. You could argue that most of the Radulovich votes went to Dufty — possible — but more likely, in the runoff, the more liberal voters who had come out in November to vote for Gray Davis for governor and also voted for Hansen just stayed home in December.


And this fall, Wiener will be more in the position that Hansen was in: There’s a third candidate in the race, Rebecca Prozan, and she’s more likely to take votes from Wiener than from Mandelman. And, of course, there’s RCV this time around — and with two gay men and a lesbian in the race, nobody really knows how the second-choice votes will play out.


Daly plays with the turnout numbers:


For the sake of argument, let’s concede that Mandelman starts out 1000-1400 votes behind Wiener among the 11,000 or so District 8 Democrats who voted for DCCC last week. Given that over 31,000 District 8 residents voted in the 2006 Supervisor race (in a contest that was not the most competitive,) we can assume that at least 20,000 additional people will vote this November. In a 2-person contest, Mandelman would need to win 53.5% of these votes in order to win. Given that less frequent voters trend significantly more progressive, and with the addition of Democratic Party branding and the weight of its mail program, 53.5% is almost assured.


Well, I dunno — in 2002, with a contested governor’s race and a contested D8 race, only 26,600 people voted, but it’s safe to say the numbers will be well above 11,000. And it’s not a two-person contest. But I think it’s also safe to say that those higher-turnout voters are the votes most likely to swing toward Mandelman.  


Jim Stearns, a political consultant with long experience in San Francisco (and no candidate in the D8 race), has another interesting analysis he sent over to me:


“Mandelman’s strategy was to spend his limited resources as part of a team effort to maintain progressive leadership on the DCCC. In so doing, he focused more heavily on slate cards that went district-wide than on mailers in District 8 promoting his own candidacy.


 Wiener, on the other hand, abandoned his fellow moderates and spent his money mostly on his own candidacy. This shortsighted strategic blunder will be extremely costly for Wiener in November.


 The result? Wiener got more votes in District 8, but lost his bid to regain his position as chair of the DCCC. Mandelman got fewer votes, but has significantly increased his chances of winning the Democratic Party endorsement this November. That endorsement is worth far more than the mere 1,000 vote difference between Wiener and Mandelman today.”


 


None of this means Walker will beat Kim and Sparks in November, or that Mandelman will beat Wiener and Prozan. It just means that I suspect the DCCC results don’t really say much about the relative strengths of any of the candidates when it comes to a focused, district-centered race in a high-turnout fall election.


I emailed Hogarth and ran the turnout argument by him. His response:


I tried to caution in my piece that there’s only so much you can see in the numbers — and that you’re right; voter turnout in November will be a lot higher.  Maybe I should have made this a bigger point.  But progressives are deluding themselves if they think turnout will be as high as it was in November 2008.  And if I were Rafael, I would have reason to worry that Scott did so much better than me in D8.  Also keep in mind that, despite the drop-off of DCCC voters, 48% of people in D8 who participated in this election cast a ballot for Scott Wiener.


Correct — turnout won’t be as high as it was in the presidential race. But it might very well be as high as it was in 2002, when there was a contested race for governor, as there will be this fall. Lots of Democratic candidates — particularly Gavin Newsom and Kamala Harris — will be doing GOTV operations in the city, and while Newsom and Harris won’t be supporting Mandelman, I don’t think either of them will limit their turnout efforts to precincts that run toward Wiener. The more liberal dems who vote in November, the better Harris and Newsom do against Republicans; that’s what they care about.


There’s no question that Scott Wiener will be a formidable contender in November. He’s got money, he’s got Mark Leno, and he’s running in a district that has elected moderate gay men since the return of district elections. But it’s remarkable how well the progressives have done in swing districts of late (see: Eric Mar, John Avalos), and Mandelman will, as Daly says, be the consensus candidate of every progressive group in town. He’ll almost certainly have the Democratic Party — which matters even more when Democrats at the top of the ticket are driving turnout. And he’ll have the same sort of boots on the ground that gave Mar a victory in a very tight race.


At this point, I think Mandelman and Wiener both have a shot at finishing first; it will probably be very close. And Rebecca Prozan runs third.


Oh, and the tenant measure? It lost because there wasn’t an effective campaign behind it. Tenant measures don’t automatically win in tenant-heavy San Francisco; time and again over the years we’ve seen that when there’s a measure that pushes the edge (and face it, I strongly supported Prop. F, but it was pushing the edge) and there’s landlord money against it, you need a full-scale concerted campaign for it. Progressives were paying a lot of attention to the DCCC, and to defeating Props. 16 and 17. Prop. F got lost. I’m not happy about that, but I’m not terribly surprised, either — and I don’t think it means much in the long run.


Chris Daly went a bit too far attacking Hogarth for his connections to Mark Leno, who is a Wiener supporter, and suggesting that the folks at BeyondChron — who are, after all, first and foremost tenant lawyers — are going to be backing Scott Wiener in the fall. I don’t see that happening; I can’t imagine it happening. I just think they read a little too much into the DCCC results.

About Peskin’s “coup”

It’s interesting that the Examiner and Chron both seem to be pushing the same slate of 24 candidates for the Democratic County Central Committee — and most of the folks on the list are not incumbents. Electing the so-called “moderate” slates would, in fact, mark a dramatic change in the politics of the DCCC — and yet, the Ex’s Ken Garcia still talks about a “progressive coup.” As if somehow the left is trying to take over a committee that hasn’t really changed all that much in years.

A few years back, the local Democratic party organization was the object of a coup engineered by former Supervisor Aaron Peskin and the aforementioned Daly that rid the group of many of its moderate members and replaced them with like-minded ultra-liberals, several of which were elected to the Board of Supervisors in large part because of the support of the DCCC, which controls slate mailers, raises money and otherwise does everything in its power to increase its power.


In fact, in 2008 Peskin was elected to the DCCC and became chair. But it was hardly a dramatic change in the commitee’s politics. Let’s look at the numbers.


You can read the list of candidates who won slots on the committee in 2006, before the supposed “takeover,” here. And you can see the list of candidates who won in 2008, the “coup” year, here. Guess what? They’re remarkably similar. In the 12th Assembly District, only three of 12 seats changed hands. Susan Hall, a progressive, retired. Dan Dunnigan and Jason Wong, both part of the more moderate wing, lost. Jake McGoldrick, Eric Mar and Michael Bornstein, all progressives, were elected. Net political change: exactly two sets for the progressives.


In District 13, Sue Bierman, an incumbent in 2006, died and was replaced by David Chiu, who was re-elected in 2008. Gerry Crowley retired, and exactly two other incumbents — Holli Thier and Bill Barnes — were unseated, replaced by Peskin and Chris Daly.


“Many of the moderate members,” Ken? Try four. Out of 24 elected seats. That’s a turnover rate of about 16 percent. Some coup.


As it turns out, the balance of power in the committee shifted just enough for Peskin to get elected chair, in a very close vote. But most of the votes on the committee, on most of the key issues, are fairly lopsided; a motion to oppose the sit-lie law, for example, passed overwhelmingly.


So the real coup attempt here is a well-funded move by downtown to oust the current incumbents and move the Democratic Party to the right. That’s what this election is about.
