Every poor and working class community in San Francisco has learned the hard way that its interests are at the bottom of the list as far as City Hall is concerned. At the top of the list are the banks, real estate interests, and large corporations, who view San Francisco not as a place for people to live and work and raise families, but as a corporate headquarters city and playground for corporate executives. By using their vast financial resources, they have been able to persuade local government officials that office buildings, hotels, and luxury apartments are more important than blue-collar industry, low-cost housing and decent public services and facilities.

Sound familiar?

It’s more than 30 years old.

Back in 1974, more than 50 San Francisco community groups — from Bay Area Gay Liberation to the Telegraph Hill Neighborhood Center, from the Federation of Ingleside Neigbhors to the San Quentin Six Defense Committee, from the Golden Gate Business and Civic Women’s Association to the Socialist Coalition — started meeting to develop a plan to take back the city.

It culminated with a Community Congress, on June 8, 1975, at Lone Mountain College (now part of the University of San Francisco). More than 1,000 people attended, and they drafted a remarkable 40-page document that outlined an alternative political, economic, social, and environmental agenda for San Francisco. The movement led, among other things, to the advent of district elections of supervisors (a key element in the platform) and the rise of active community-based organizations in this city.

Calvin Welch and Rene Cazenave, the veteran activists who run the San Francisco Information Clearinghouse, were among the organizers. They found the old manifesto recently and sent it out to a few of us by e-mail. I’ve posted it on the Politics blog. It calls for rent control, a sunshine ordinance, a health commission, full-time supervisors (who were to be paid $20,000 a year, the equivalent of $86,000 today), cable-TV coverage of the supervisors meetings, a mandate that developers build affordable housing and a feasibility study on public power. In fact, much of what the left has achieved in San Francisco in the past three decades is outlined in the Community Congress document.

(The congress also called for decriminalization of victimless crimes, including public inebriation, a guaranteed annual income, the abolition of the criminal grand jury, and some other things that didn’t quite come to pass.)

I mention this not only because it’s a fascinating historical document but because Welch and Cazenave think it’s time for a new Community Congress. Their draft agenda refers to a New Deal for San Francisco, and they’re talking about holding a series of meetings culminating in a major session sometime next year.

It’s tough to get the San Francisco left to come together on issues, even harder to build a broad-based organization that can push an agenda. Sup. Chris Daly tried several years ago, but the San Francisco People’s Organization never got the traction many of us had hoped for.

But although the progressives have accomplished a tremendous amount in this city, and have come a long way since 1975, the need is still there.

"San Francisco’s downtown corporate and banking interests and their representatives in city government are attempting at a local level to shift the burden of the current economic and political crisis ever more fully onto the backs of the poor and working people of San Francisco."

That was then. Today, Welch and Cazenave write, "San Francisco stands at a crucial junction brought about by the collapse of the real estate based speculative bubble and the related steep reduction of city revenue resulting in cuts in funding important programs and services … There needs to be a general coming together of community groups to articulate a set of policies able to be implemented at the local level which seek to maximize community control over the provision of critically needed health and human services and beneficial community development and to maintain a vital public sector."

Sounds like a plan. *

Right Ebbs, Left Gains as Media ‘Experts’
Think tank balance still skews right

FAIR’s just-released annual think tank study shows think tank citations declining for the fourth year in a row in 2008, as newspaper column space devoted to national and international news continued to shrink. The decline was particularly notable for conservative think tanks’ citations, while progressive think tanks increased in number.

The study, a special online-only feature of FAIR’s Extra! magazine, is available at http://www.fair.org/index.php?page=3857.

Among the study’s findings:

-The overall decline in citations primarily hit conservative or right-leaning think tanks, whose share fell from 36 percent to 31 percent in 2008, while progressive or left-leaning think tanks increased from 17 percent to 21 percent.

-Centrist tanks still dominated with 48 percent, and the centrist Brookings Institution, the top-cited think tank, had more than twice as many citations as its nearest competitor, the conservative American Enterprise Institute.

-Progressives were cited 30 percent less than conservatives, and half as often as centrists.

-Progressive and left-leaning think tanks took a record five spots in the top 15 most-cited list, and had by far the greatest percentage increase of citations in this annual survey. The most notable increase was in progressive think tanks with an economic focus, such as the Economic Policy Institute, the Center for Economic and Policy Research and the Center on Budget and Policy Priorities.

Michael Dolny, author of the study, noted, “Both the economic crisis and the poor showing of conservative candidates in the 2008 elections appear to have raised questions about the role of conservative think tanks.” However, pointing out that despite these gains, progressive think tanks are still underrepresented compared to their centrist and conservative counterparts, he also observed that “we are still a long way from true diversity of news sources.”

What went wrong

EDITORIAL David Dayen, a political blogger at Calitics, had the best line on the California budget crisis.

"Whoever cares the least about the outcome wins," he wrote July 20. "If you don’t care whether children get health care, whether the elderly, blind and disabled die in their homes, whether prisoners rot in modified Public Storage units, whether students get educated … you have a very good chance of getting a budget that reflects that."

In the end, the Republicans largely carried the day because they had all the power: they could block any budget deal, they refused to raise any taxes, and they don’t really care if the state goes bankrupt. In fact, Gov. Schwarzenegger was happy to draw the crisis out as long as necessary — it helped his poll rating.

San Francisco should have had a very different situation and a very different outcome. The progressives control the Board of Supervisors and the mayor is in a tight spot — he’s running for governor and wants to show that he can manage San Francisco better than anyone in Sacramento is managing the state. It’s part of his campaign theme. A prolonged budget standoff was not in his interest.

And while the city budget is far, far better than the state budget, and the progressives managed to get a few concessions, the bottom line remains: this is a no-new-taxes budget, balanced largely with cuts and regressive new fees. In fact, for all the mayor’s talk of working with the board on possible tax measures, it now appears likely that there will be no revenue proposals whatsoever on the November ballot.

And the mayor is going to make another deep round of cuts soon, when the figures on what San Francisco will lose in state funding (almost certainly more than $150 million) become available.

It took last-minute efforts by Sup. Ross Mirkarimi, supported by Sup. David Campos, to win back funding for the Public Defender’s Office and at least a shot at funding the public finance system for the next local elections.

The supervisors, frankly, should have pushed harder. The message to Newsom should have been: no budget without new revenue. And as the board approaches the next fiscal year — projections already call for a $300 million deficit — that absolutely has to be the bottom line. Critical services have been cut too deeply already.

The process needs to be better too. Allowing two supervisors — the budget committee chair and the board president — to negotiate a closed-door deal with the mayor without briefing their colleagues or letting the other stakeholders know what was going on was a big mistake that can’t be repeated.

The New York Times ran a front-page story July 21 describing in bleak terms how California has abandoned its safety net and given up the ambitious dreams that for so long defined the state. "At no point in modern history," reporter Jennifer Steinhauer wrote, "has the state dealt with its fiscal issues by retreating so deeply in its services, beginning this spring with a round of multibillion-dollar budget cuts and continuing with, in total, some $30 billion in cuts over two fiscal years to schools, colleges, health care, welfare, corrections, recreation and more.

That can’t be the model for San Francisco to follow. *

The SF budget battle continues

The full Board of Supervisors votes on the San Francisco budget tomorrow (Tuesday), and there are still some serious issues on the table. Among other things, the budget doesn’t include adequate money for public financing of the upcoming supervisorial and mayoral elections, and that’s big deal: Public financing is a crown jewel in San Francisco’s political reform efforts. The Public Defender’s Office is way underfunded (which is silly since criminal defendants are guaranteed legal representation, and hiring outside counsel is more expensive than funding the PD). Key social services are still taking a huge hit. There are still plans for 1,500 layoffs of city employees this fall — and that means a lot of what people depend on San Francisco for won’t get done. (Among the most painful: The loss of recreation directors, who are mentors for hundreds of kids.)

Sup. Ross Mirkarimi wants to find another $4 million to $6 million to fund public financing and some other services — and he’s looking to take that from a few areas that haven’t exactly been sharing the pain. For example, thanks to a push from Budget Committee Chair John Avalos, the Fire Department actually took some cuts. But the Police Department didn’t. While the Service Employees International Union Local 1021 gave back $40 million and is facing 1,500 layoffs, the Police Officers Association gave back nothing.

The problem with that, of course — besides the fact that it isn’t fair — is that the next time the city faces a budget crisis, which is probably going to be next year, the firefighters won’t want to give up a penny. Hey, they took the hit last time, and there was no parity from other public-safety areas. And if you think Local 1021 is going to be coming to the table with more cuts, you’re crazy.

So Mirkarimi told me he thinks that between the police, the Hotel Tax funding for the Convention and Visitors Bureau and the big arts organizations (the opera and symphony, whose patrons by and large can afford to buy tickets without as much city subsidy) there’s enough to fill some critical gaps in the budget.

It’s going to be tricky — Avalos and Board President David Chiu negotiated the budget deal with the mayor, and it will be hard for them to push at this late date for more changes. But Avalos told me he’s “open to” Mirkarimi’s proposals and will give them all due consideration. So, by the way, did Sup. Bevan Dufty: “I’m open to it,” he told me. “I have some concerns about the budget and will listen to any ideas.”

So the budget battle still isn’t over — and tomorrow’s meeting will be fascinating.

In Mexico, the Dinosaurs return

MEXICO CITY (July 16th) — Nine years ago, on a sultry July morning, Mexicans woke up and discovered to their great amazement that the Dinosaur that had hunkered down at the foot of their beds for 71 years was gone. This July 6th, when Mexicans rose in the morning, the Dinosaur was back.

In the famous short poem by Augusto Monterroso, the Dinosaur is the PRI — the Institutional Revolutionary Party — once the longest-ruling political dynasty in the known universe that controlled the destiny of Mexicans from the cradle to the grave for seven interminable decades until it was dislodged from power by the right-wing PAN party in the July 2000 presidential elections. In its unslakable thirst for power, the PRI committed unspeakable crimes against the Mexican peoples, stealing elections from the most humble city hall to the presidential palace, jailing and torturing and executing those who stood in its way, and emptying out public treasuries in an unmatched kleptocracy that was a legend throughout Latin America, “the perfect dictatorship” Latin American novelist Mario Vargas Llosa once dubbed it (for which the PRI had him tossed out of the country).

“Have we Mexicans lost our memories and our minds?” asks Sylvia Insulza from behind the counter of her newspaper dispensary in the old quarter of the capital. Tears of frustration crystallize in the corners of her eyes.

The depth and breadth of the PRI victory July 5th is nothing short of stunning. From a distant third-place finish in the 2006 presidential fiasco in which the rightist PAN stole the election from Andres Manuel Lopez Obrador (AMLO) and his left-wing PRD party by .57% of the popular vote, the PRI (“proven experience and a new attitude” is its current campaign slogan) took 37% of the total ballots cast, nearly doubling its votes three years back, and taking control of congress for the first time since 1997. The once-upon-a-time ruling party’s alliance with the so-called Mexican Green Environmental Party (PVEM – see sidebar below “The Green PRI”) will give it 259 seats out of 500 in the lower house, an absolute majority. In nine out of 31 states, the PRI won every office up for grabs — federal congressional representatives, local congresses, and municipal officials, a “carro completo” or “full car” in the Institutionals’ curious lexicon.

The Dinosaurs also proved triumphant in five out of six governors’ races, winning two statehouses in which the PAN had resided for 12 years. Only in the northern border state of Sonora, where the PRI governor was seen as complicit in the tragic incineration of 48 babies in a Hermosillo day care center a month before the election, was the PAN able to squeeze out a victory in an election in which the PAN and PRI candidates were cousins.

Moreover, the PRI won cities like Naucalpan, an upper middle class Mexico City suburb the right-wingers have controlled since the 1980s, and the nation’s second city, Guadalajara, which the PAN has owned since 1995. In alliance with the Mexican Green Environmental Party, the PRI won its first elected office in Mexico City since 1994. Although the left PRD maintains control of the nation’s capital, the Party of the Aztec Sun does so by a greatly reduced margin. Whereas the PRD registered 51% of the vote in Mexico City in 2006, three years later it weighs in with just 29%.

But Sylvia’s tears of frustration may soon dry. Whether the Dinosaurs are really back or just staying overnight (in Jurassic time) is not yet clear. Mid-term elections are referendums on the sitting president and his administration’s management of the country and July 5th represented a crushing vote of no confidence in Felipe Calderon on whose watch the economy has tumbled into freefall — “growth” in 2009 will measure a negative 8%, the worst slide since the Great Depression of 1929-32. Calderon, who campaigned as the “President of Employment,” has presided over the loss of 2,000,000 jobs. The president’s ill-advised war on the drug cartels has soaked the country in blood — more than 12,000 lives have been lost — and fueled corruption and human rights abuses on the part of the military and the police. Calderon’s panic-driven handling of this spring’s Swine Flu “PAN-demic” kicked the bricks out from under the tourist industry, the nation’s third-largest source of dollars, and his arrogant imposition of candidates in the July 5th vote-taking angered and turned many in his own party against him.

So, OK, I just got engaged. Gay engaged. Engayged.

So weird.

First, this may be the worst time ever to plan on jumping the lavender chuppah knot or whatever. As far as legality goes, California’s up in the air until maybe the November 2010 elections and perhaps for a long time after that. Then there’s the whole federal kerfuffle to go through. And Iowa might be tempting right now — but gurl, I don’t have enough something blues for three ceremonies. Iowa, then Cali, and then federal — sheesh! Two is enough! At least when we were illegal, we only had to plan for one polka band. Miss you, "commitment ceremony."

Then there are the political equivocations. Plus or minus a few episodes of America’s Next Top Model, I’ve considered myself near the front lines of radical queer resistance ever since my friends started dying of AIDS when I was 17. I’m all for ethical non-monogamy, get queasy at the thought of official state-sanctioned relationships, and definitely believe that marriage, with all its financial benefits, discriminates against people who haven’t fallen in love. Or turns them into liars for money. Or makes them scream a lot during Sex and the City reruns.

Hunky Beau and I aren’t really after the cash and perks, anyway. Hospital visitation rights and insurance discounts would be cool (and are available locally already), and who knows if we’ll have kids who’ll require federal protection. But I’m pretty sure we’ll never need the legal right to “enlarge accommodation estimates for foreign dignitary missions” only available to married couples now. And as far as political statements go, there are a lot more things in my personal life that I’d like to see being used to help change the world for the better. Housing homeless queer kids and seniors and restoring the recent awful AIDS services cuts seems much more necessary right now as well. But this is the fight our community’s in — and whether it’s because I was raised that way by two incredibly supportive parents, or because I get a real rash when my government says I can’t do something other people can, or because within every loud-mouthed queen lives a hopelessly traditional romantic, I’ve got a dog in it. Not a chihuahua, mind you. More like golden retriever. Totally butch.

As some of our writers eloquently point out in this issue, same-sex marriage may be a boondoggle, sapping our community’s strength to confront real issues of poverty and inequality. It’s certainly not for everyone. But in a truly dark time in my life, when I thought the whole world was falling apart, I suddenly fell in deeply in love with someone almost annoyingly perfect for me in every way. To my continued astonishment, he seems to feel that way about me as well. We’ve been together a long time now and marriage seems, to us, the logical next step for whatever reason. It just feels right. Love is a crazy, crazy thing, full of diversity, surprise, and wonder. Isn’t that what Pride’s all about?

Will downtown go after IRV?

Interesting meeting at the Chamber of Commerce office yesterday. In attendance, I’m told by a good source, were Chamber CEO Steve Falk, Senior Vice President Jim Lazarus, Nathan Nayman from the Committee on JOBS, Pamela Brewster, vice-president for government affairs at Charles Schwab, Wade Rose, vice president at Catholic Healthcare West, and some other downtown types.

Among the topics: A campaign to repeal the city’s Ranked-Choice Voting system.

Downtown has never liked RCV, also known as Instant Runoff Voting. The Chamber and Committee on JOBS folks also dislike the fact that they’ve gotten their butts kicked in the past few supervisorial elections — and instead of finding better candidates, or recognizing that the electorate really isn’t interested in a pro-corporate Republican-style agenda, they’ve decided to go after “the system.”

I couldn’t reach Falk today, but Lazarus called me back. He said the Chamber had polled this year on both district elections and IRV, and found (no surprise) that the public loves district elections, and that trying to return to a citywide system was a nonstarter. And while support for IRV was also strong, the voters, according to the Chamber poll, would be willing to consider direct runoffs between the top two finishers if the voting were all done by mail.

That, presumably, would keep the cost down and the turnout up.

“The Chamber has always been in favor of direct runoffs,” Lazarus told me. That allows the top two candidates to directly address their differences on the issues. With multiple candidates in the race, the issues aren’t well defined.”

Steve Hill, who works at the New America Foundation and was one of the architects of IRV in San Francisco, pointed out that direct runoffs have been tried in San Francisco. “That what we used to have,” he told me. “And we saw regular attack ads and nasty campaigning. The Ethics Commission found a four-fold increase in independent expenditures during direct runoffs.”

In other words, direct runoffs allow groups like the Chamber and its allies to dump huge amounts of money into negative campaigns in a short election period. “Getting rid of IRV is a vote to empower special interests,” Hill said.

Lazarus told me he’s not sure what the next steps would be, and whether the Chamber would push a Charter Amendment campaign to repeal IRV. “We’ve talked about it,” he said. “That’s all.”

Newsom’s shell game, Part I: Public financing

Board of Supervisors budget analyst Harvey Rose is still busy researching Mayor Gavin Newsom’s city budget proposal in advance of the Budget Committee’s first hearing on it on June 17. But some advocates have already started to unearth deceptive budgetary shell games by the mayor.

Electoral reform advocates Rob Arnow and Steven Hill have discovered that Newsom has once again raided the public financing for mayoral candidates fund, but sought to disguise the move by including a $1.9 million contribution to the fund in his published budget, then draining $1.4 million from a fund transfer that wasn’t highlighted. And that doesn’t even count the $5 million “loan” that Newsom last year took from the fund – which he opposed the creation of — promising he’d pay it back this year.

“For the last three years, the mayor has been trying hard to bankrupt the public campaign financing fund, well before the budget crisis began. While he’s claiming now that it’s only a response to the budget crisis, the reality is far different. Despite his carefully crafted media image, he’s backed by big business interests who can’t stand the idea of regular citizens taking back the reins of our democracy,” said Arnow of the group San Franciscans for Voter Owned Elections.

OPINION At the end of World War II, approximately 36 percent of American workers belonged to a union. Today that number has shrunk to about 12 percent, lagging behind the world’s other industrial democracies. But now, with a Democratic president in office, we have a realistic chance of enacting the most significant piece of labor legislation in decades, the Employee Free Choice Act, which would protect the right of workers to organize into a union.

The opposition, of course, is well organized and well funded. Opponents will spend more than $200 million to defeat the bill in the Senate. They will argue that EFCA is just a special interest bill that helps big labor. But the truth is that the legislation should be part of the long-term economic recovery plan and is key to rebuilding the middle class.

In 1980, average CEO pay was 42 times that of the average blue-collar worker. By 2006, CEO pay had grown to 364 times the average blue collar worker’s pay. A survey of median weekly earnings in 2007 revealed that union workers make 30 percent more than their nonunion counterparts, and are 59 percent more likely to have employer-provided health coverage than other workers.

The key EFCA reform, and the one that has generated the most controversy, is called “card-check.” Under EFCA, if the National Labor Relations Board (NLRB) finds that a majority of employees have signed written authorization forms designating the union as their collective bargaining representative, the union is certified.

Opponents of card-check often argue, erroneously, that EFCA will deprive workers of their right to a so-called secret ballot. In fact, EFCA preserves both options, but it places the choice in the hands of workers, not employers. Moreover, the history of these “secret ballot” elections shows that they are often anything but democratic. Too often employers use their power over unorganized employees to intimidate them into voting against the union. Such documented employer tactics have included mandatory attendance at antiunion meetings, one-on-one meetings, threats to close the business if the union wins the vote, and harassing or even firing workers engaged in organizing activity.

Sen. Dianne Feinstein has an 87 percent lifetime voting record from the AFL-CIO and has co-sponsored EFCA in the past. But now, with EFCA finally within reach, she has announced that she is looking for a “less divisive” option.

Say it isn’t so, Senator.

For many years progressive activists have had concerns about Feinstein, even going as far as to seek her censure at a state Democratic convention two years ago. In 2007, the party leadership reminded the activists that although she may stray occasionally, Feinstein is really a good Democrat who shares our basic values and commitments. There was no censure.

But workers’ rights is no side-issue in our Democratic Party. Economic justice is the issue. This is a moment of truth for Feinstein — and all of us who are her constituents have an obligation to help her get to the right answer.

Downtown marshals its forces

The folks who got their collective asses kicked in last fall’s elections also got the message — that their politics, their candidates and their messages aren’t working — and they’re quietly meeting to map out a new strategy to try to take back some seats on the Board of Supervisors in 2010.

A meeting earlier this week, convened by former SFSOS staffer Ryan Chamberlain, drew representatives of the Chamber of Commerce, the Committee on JOBS and candidates like Scott Wiener, a Democratic County Central Committee member who is planning to run in District 8.

“What we’re doing isn’t working,” Chamberlain told us. “The progressives are winning.”

So downtown is looking to build grassroots operations — and the message right now is “quality of life.” That means cracking down on homeless people, cleaning up the streets, more cops, probably a move toward allowing more condo conversions (homeowners tend to vote more moderate than renters, so these folks love the idea of having more owners and fewer renters in town).

Chamberlain wouldn’t give us a list of who attended, but one source familiar with the meeting told us the Chamber and JOBS were well represented. Wiener confirmed that he was there, but wouldn’t say anything else about the meeting. Sup. Sean Elsbernd told us he was invited, but couldn’t make it.

So let’s remember: The progressive victories last November were hard-fought. This is still a battle for the soul of the city, and the other side isn’t anywhere near ready to concede. In fact, the downtown guys have plenty of money and sophisticated political strategists and they’re lining up candidates.

Union showdown

The Oakland-based United Healthcare Workers is bracing for an imminent takeover by its parent, Service Employees International Union, after defying an SEIU ultimatum to support the transfer of 65,000 UHW nursing home and homecare workers to a new local — without a member vote and with leadership appointed by SEIU.

The power struggle between SEIU President Andy Stern and UHW head Sal Rosselli and their respective boards, which has been escautf8g for the last year (see "A less perfect union," 4/9/08), came to a head Jan. 22 when SEIU’s International Executive Board approved findings of fiscal shenanigans and insubordination by UHW leaders and threatened to oust them and institute a trusteeship if six conditions were not met within five days.

To determine its response over the weekend, UHW organized meetings with about 5,000 of its members in San Francisco and four other cities, announcing the response during a raucous press conference at the Oakland headquarters the morning of Jan. 26, a day before the SEIU deadline.

"You ready everybody?" began Rosselli, flanked by a rainbow of 30 members and signs like "Hands off our UHW" and "Don’t Silence our Voices." The energized crowd of about 100 supporters answered with an enthusiastic, "Yeah!"

At that 11 a.m. rally, and in a teleconference an hour later with reporters from across the country, including from the Los Angeles Times and The Washington Post, Rosselli began by describing the UHW (which began with San Francisco General Hospital workers about 75 years ago) as perhaps the most effective, democratic, politicized, and oldest health care union in the country.

"We have an ideology that there’s no limit to empowering workers," Rosselli told reporters, announcing that UHW has unanimously approved a response letter to Stern that he characterized as "a compromise to avoid a civil war and get to the path of reconciliation."

But SEIU spokesperson Michelle Ringuette, while noting that her union’s leadership had not yet decided how to respond by Guardian press time, said the findings and conditions by special hearing officer Ray Marshall (who was the labor secretary under President Jimmy Carter) "was not a negotiation."

Marshall’s 105-page report concluded that "Leaders of the UHW did engage in financial malpractice and undermined democratic procedures when they transferred UHW funds to a nonprofit organization to be used in contests with the International Union." It set out conditions to avoid trusteeship that included supporting the transfer of long-term care workers, greater fiscal oversight by SEIU, purging the UHW database of names pilfered from SEIU, and publicizing the Marshall report to its members.

"Given that Sal Rosselli and his leadership team were just found guilty by Secretary Marshall of financial wrongdoing and trying to subvert the democratic processes of this union, there’s nothing surprising about this letter," Ringuette told the Guardian.

Yet an insistence on democratic processes was at the heart of the UHW stance against SEIU, which UHW leaders accuse of sacrificing the autonomy of locals in its drive for more national power, appointing leadership based on loyalty to Stern, colluding with large corporate employers, and turning a blind eye to corruption by Stern loyalists that was far more serious than any accusations against UHW.

UHW agreed to some of SEIU’s conditions, but insisted that its members be allowed to vote on the merger and elect their own leaders, and that SEIU work with UHW to craft a union that best represents member interests. In addition, it called for a mediated reconciliation process with SEIU that could culminate in a vote to create a single union representing all health care workers in California.

UHW members are fiercely loyal to that organization. To illustrate UHW’s effectiveness, Rosselli noted that SEIU locals representing nursing home workers recently negotiated contracts with wages $4 per hour less than UHW contracts and without UHW’s strong patient advocacy provisions. He also said that while UHW represents about 20 percent of statewide SEIU workers, the union filled 55 percent of the volunteer shifts in state and local elections.

"We’re a very democratic organization, and that’s what we believe is the key to our success," Rosselli said. "Workers want a strong voice in dealing with their employers, not just another boss in Washington, D.C."

All sides of the conflict express a desire to move forward. As Marshall wrote, "The UHW-SEIU conflict is hurting both organizations at a critical time in the development of the labor movement and progressive policies in the country." But it could be that the two sides have staked out intractable positions.

Rosselli was realistic about whether SEIU will accept the UHW counteroffer, telling reporters, "I don’t think it’s likely, but we hope that they will."

And what if they don’t?

Rosselli was careful to avoid threatening to lead an effort to disaffiliate UHW from SEIU if the trusteeship happens, noting that such advocacy is against SEIU rules and refusing to answer questions from reporters pushing the issue. But he made that possibility clear with statements such as "Our members have instructed us to resist this undemocratic transfer."

As to how UHW leaders will respond if and when SEIU takes over UHW and ousts them, Rosselli read from a prepared statement that said, "We would convene a meeting of our currently elected leaders and decide what to do next."

During the Oakland rally, Rosselli went a little further, reminding UHW members that they always retain the right to form a new union. The crowd applauded for 40 seconds and chanted, "Can we? Yes we can! Will we? Yes we will!"

As the conference concluded and attendees trickled away, homecare worker Tena Robinson grabbed a Guardian reporter and said she had a message to convey: "Andy Stern, we will never surrender!"

As she said it, Rosselli came over to hug her, as if embracing a family member. And then she told Rosselli that if he goes, "I’m going with you!"

The class of 2008: an agenda

OPINION Every few years, San Francisco’s political landscape is remade. But we, the new arrivals of the Board of Supervisors’ Class of 2008, know that the last decade of district elections helped ensure that the supervisors truly represent our neighborhoods and our shared San Francisco values.

Despite various efforts by special interests to paint us as out of step with everyday San Franciscans, the very strength of our campaigns was that they were rooted in the lives of actual residents who understood the choices before them. We campaigned on the best of our experiences — neighborhood activism, labor and community organizing, running nonprofits and small businesses, and championing public education and police accountability.

Despite our different districts and diverse constituencies, we rallied voters around real San Francisco values — the faith in the role of government to protect the most vulnerable and bring forth justice and equity; the trust in grassroots democracy and neighborhood-based activism; the pursuit of a safe and clean environment and sustainable development; the belief in the sanctity of immigrant, labor, and LGBT rights; the dignity of working families, seniors, and people with disabilities; and the pursuit of housing justice and economic opportunity for all.

While the Class of 2000 paved the way on many of these progressive values, we enter public office ready to build on this foundation while rising to the new and enormous challenges of today. San Francisco is not just facing a fiscal crisis; we are facing a quandary in which city government cannot do all that it aspires to do.

Our agenda is no less ambitious for the crisis we are in. It is because of the crisis that we need to create opportunity, direction, and hope where there is violence, confusion, and despair. Our San Francisco values mean that we will tackle public safety by addressing the root causes of violence by seeking rehabilitation and restorative justice and push for real police reform by promoting the kind of community policing that is built on relationships between neighborhood residents and the police.

Our San Francisco values prompt us to make our city budget more transparent. We will initiate new programs only with the certainty that important services are not cut in the process. We will do our best to protect critical frontline city workers from privatization and layoffs.

We will work collectively to maintain the city’s commitment to its public schools; promote public transit; foster sustainable development and new affordable housing connected to green and well-conceived public infrastructure; promote community choice aggregation and public power based on renewable energy; support local businesses and the hiring of San Francisco residents; safeguard our sanctuary city to make sure that immigrants can live free from fear of ICE raids; and fight to keep our vital neighborhood services working and our parks, libraries, and senior centers thriving.

We are committed to ushering in a new tone of cooperation and unity in San Francisco. Despite the enormous challenges and contending political views within the city family, we will work to ensure that our neighborhoods always win out over special interests. After all, politics is about improving the lives of everyday people. We look forward to working with you in this noble effort.

Sharing the pain

When Mayor Gavin Newsom walked across City Hall to the Board of Supervisors Chambers last week to announce that the city is facing a $576 million budget deficit, it looked as if he was putting political differences aside and genuinely inviting the board to "share the challenge" of bridging the 2008-09 budget chasm.

For years, voters and supervisors have urged Newsom to appear before the board for monthly policy discussions. And for as many years, Newsom has refused, claiming such invites were "political theater." Now that he’s finally made the trek, critics say the context makes the gesture more theatrical than substantive.

Within minutes of Newsom’s unannounced Dec. 9 visit to the board, City Hall insiders began to fear that the Newsom was only pretending to walk the unity talk: details of his $118 million in proposed mid-year solutions were not made available before the appearance, giving the two sides little to discuss and raising questions of due process.

"If the mayor was interested in real collaboration with the board, he would introduce his mid-year proposal to the board for our deliberation, just like the annual budget," Sup. Chris Daly told the Guardian. "But after we asked in three different ways, we found that he will be making over $70 million in cuts unilaterally — without the board’s approval. Now we have to figure out how to get the public a seat at the budget table."

Unlike during the normal budget process, the mayor has tremendous power to make cuts mid-year. But with details slow to emerge, the legislators weren’t the only ones left in the dark about the proposal, which includes slashing the Department of Public Health’s budget by 25 percent, cuts that DPH director Mitch Katz told the supervisors is going to require fundamentally changing how government runs.

Several City Hall workers told the Guardian how, in the days after Newsom made his budget deficit announcement, Controller Ben Rosenfield was seen running from department to department, trying to track down the program-level details.

Supervisor-elect John Avalos, who has a deep understanding of the budgetary process from his years as a legislative aide to former Budget Committee chair Daly, confirmed that the mayor’s $118 Million proposal "doesn’t tell you much."

"There is $47 million in increased revenue that has come in that offsets the shortfall, and there’s a higher-than-expected census at San Francisco General Hospital that allows us to recoup some money. But although there are all kinds of service/non-service cuts in Newsom’s proposal, we have no details to work with," Avalos told the Guardian.

Two days after his board appearance, Newsom penned an op-ed for the San Francisco Chronicle in which he again appeared to be holding out his hand to the board. But Avalos, a candidate for president of the board, observed that Newsom continues to protect his own pet projects, which include the 311 Call Center, the Community Justice Center, and the Small Business Assistance Center.

"The pain needs to be shared and minimized all round," Avalos warned. "The mayor needs to come forward and help us, not simply cut all the programs that the Republicans want to see cut. There is this huge backlash from folks saying, ‘Why do we spend $1 billion on our public health system? Maybe we don’t need public health.’ But our services are there for a reason."

Avalos said he worries that if we cut all these programs now, it will be very hard to get them back down the line. "When revenue is back, the focus will be on things that are important, but not on services that help the most vulnerable folks," Avalos predicted.

Within three days of Newsom’s appearance before the board, Peskin had figured out a mechanism whereby the public could weigh in on Newsom’s cuts: he introduced legislation that combines the mayor’s $118.5 million proposal with an alternative $8.5 million in cuts that Peskin has proposed.

"So, now there’s a de facto collaboration," Peskin told the Guardian. Peskin’s package of alternative cuts — which has since been pared back to $5.5 million because duplication with the mayor’s list was found — includes budget reductions in the Mayor’s Office of Economic and Workforce Development, Emergency Management Department, Fire Department, Police Department, Mayor’s Office of Criminal Justice, the 311 call center, and city grants to the opera, ballet, and symphony. Peskin is also proposed wage freezes that could save another $35 million.

Peskin’s counter-move allows the public to weigh in on the combined proposals. It requires department heads to publicly defend cuts to programs, services, and personnel — cuts that were developed, per Newsom’s request, behind closed doors. Or as Daly put it: "The mayor’s and the board’s proposals need to be deliberated not through a staff member to the mayor, but in full view of the public."

The board also wants to publicly discuss the layoffs, which Newsom said would total 399, a number that rose to 409 when the list was actually released. Peskin’s legislation also provides an avenue for fired workers or their representatives to publicly air discontent. A list of eliminated positions obtained by the Guardian shortly before press time shows that most of the positions were service providers making less than $70,000. Although union officials have complained that the ranks of highly paid managers has grown sharply since Newsom became mayor (visit sfbg.com for the complete list and more analysis).

SEIU’s Robert Haaland estimates that 75 percent of layoffs targeted line workers in service jobs. "As far as we can tell, the pain is all at the bottom," Haaland told the Guardian.

And while Haaland didn’t openly support Peskin’s counter-proposal — a citywide sliding scale of pay cuts in which the highest earners take a bigger hit and an across-the-board union wage freeze — he acknowledged that at least the proposal targets the powerful Police Officers Association and the Municipal Executives Association, and not just SEIU workers.

Haaland claims that under Newsom’s behind-closed-doors method, "the institutional bias of department heads tends to come into play" in making layoff decisions.

"It’s human nature. No one talks about it, and I don’t know that there’s a grand conspiracy," Haaland said, expressing his belief that it’s easier for managers to cut people they don’t work with than those around them or people at the top. "They also tend to target the union activists, the members who are a pain in the butt, and who they don’t like."

Newsom told the Chronicle in a Dec. 15 article that "labor is going to be a principal part of the solution." Tim Paulson, executive director of the San Francisco Labor Council, told the Guardian that "the SFLC is listening to its affiliates to see if there are any collective strategies." But Haaland observed that the city is "contractually obligated to the unions," which may further complicate ongoing negotiations.

With Sup. Bevan Dufty advocating to restore more than $500,000 in HIV/AIDS funding cuts and Sup. Sophie Maxwell is trying to avoid cuts at the Small Business Center, newly sworn-in Sup. David Campos stressed the need for a meaningful vetting process.

"It’s important for us to have a process that sheds light on the human impacts of the proposed cuts so we have a better sense of what it means to citizens of San Francisco," Campos said at a Dec. 12 board committee hearing.

Campos also made it clear that he is not afraid to target the arts, arguing that deep-pocketed patrons can help ease their pain, even as advocates countered that attacking entertainment will further deplete the city’s coffers by potentially hurting tourism. "As much as we appreciate the need to support the arts, we’re going to have to look at other avenues some of those folks can turn to, to get the funding that is needed," Campos warned. "People who have the greatest needs don’t have those options. "

With repeated rounds of painful cuts predicted in the next six months, Peskin told a Dec. 12 Government Audits and Oversight Committee hearing that it’s critical for the board to express its priorities. "These include keeping Rec and Park facilities open, providing basic mental health services, and preserving public sector jobs," Peskin said. "It’s also important that everyone share the pain, but not necessary that everyone share the pain equally."

Outside the meeting, laid-off worker Allanda Turner described her pain and the devastation she feels at being let go in the midst of a recession. "I’m a parent. I just purchased a home. I’m feeling almost no hope at all," said Turner, who fears she will be applying for the medical services, unemployment, and food stamps that she refers clients to as part of her job with the city’s Human Services Agency.

"The mayor always says he advocates for the poor, but we are the most underpaid," she said. Meanwhile, while her colleagues claim that their department "gave Newsom what he wanted" by adding layoffs to an original list of cuts that included fewer jobs.

"These are unit clerks, employment specialists, eligibility workers, and line workers," said Sin Yee Poon, a DHS contract manager. "Eight of them are child-protection workers."

There will be one last meeting of the current Board of Supervisors in January, and both incoming and outgoing members are already specuutf8g that unless Peskin’s legislation passes with a veto-proof majority, the mayor will veto it and this period of symbolic unity will come to an abrupt end.

"We have the capacity, the ingenuity, and the spirit to solve this," Newsom told the board. "It’s going to take all of us working together. It’s in that spirit that I am here. The mid-year solution — difficult and painful as it is — it’s the easy part. The difficult part comes in the next four months."

But as legislators explore the possibility of adding to their budget tools in the future through charter amendments and special elections, one aide stressed the importance of taking an active role now.

"It’s important for the board to set the stage now for the budget discussions in the spring."

I was out of town the day Tom Ammiano appeared at his final meeting as a San Francisco supervisor. Too bad; I would have gone, no matter how busy I was, just to be a part of history.

I know that sounds silly. The Barack Obama inauguration will be part of history. The election of Harvey Milk was part of history. Ammiano’s last day? Hey, the guy’s moving on to Sacramento. Take a bow, everyone says thanks, and another local politician takes another political job. History?

Well, yeah, actually. Because when the history of progressive politics is written in this town (and I hope some other poor sucker takes on that job so I don’t have to) Tom Ammiano will go down as a central figure in the movement that turned San Francisco around.

It’s worth noting that the movie Milk, celebrating the life of the gay pioneer, opened around the same time Ammiano was clearing out his City Hall office. The connection goes deeper than the fact that they were both queer men fighting for basic human rights and dignity at a time when that was a huge uphill struggle.

Milk was part of an urban movement that came out of the 1960s and came of age in the 1970s that sought to wrest control of San Francisco from a cadre of military and big business leaders who had been running it since World War II. The agenda of the crew that we collectively refer to as "downtown" was turning the sleepy port city of the 1930s into the financial headquarters for Pacific Rim trade. They wanted San Francisco to be another Manhattan; they laid plans, they put the machinery in place — and they never asked the people who lived here whether that was the future we wanted.

Because all that downtown development meant higher rents, more evictions, gentrification, budget deficits, too many cars, the death of small businesses … and by the mid-1970s, the activists had figured out how to fight back. It started with electing supervisors by district so that big money didn’t always carry the day.

Milk was elected supervisor as part of the progressive push that put George Moscone in the Mayor’s Office. And if Moscone and Milk had lived, it’s possible that the tide could have turned right then. But the assassinations derailed district elections, turned the city back over to downtown, and sentenced the San Francisco left to more than 20 years of tough political dark ages.

Ammiano got elected in that era, when the developers called all the shots, when tenants and environmentalists and neighborhood people were lucky to get two or three votes on the Board of Supervisors. His pro-tenant and anti-development proposals never even reached the desks of mayors who would have vetoed them anyway.

But he didn’t give up, and in 1999, in the bleak days of the dot-com boom, he took on a long-shot campaign for mayor that, in one six-week period, reenergized the San Francisco left. With his help, district elections came back; and with his leadership, a decidedly progressive board took office in 2001. Living wage, sick pay, universal health care, bike plans, real estate transfer taxes, tenant protections … these are all products of that change.

Ammiano was an odd sort of leader, someone with a sense of humor who didn’t take himself anywhere near seriously enough. He would be the first to credit the movement, not the man — and he’d be right. But when we needed him, he was there.

“The man. The myth. The legend.”

That’s how Board President Aaron Peskin introduced Sup. Tom Ammiano, as he bid farewell to the longest serving member of the San Francisco Board of Supervisors at today’s Board meeting.

Headed to Sacramento to serve in the State Assembly, Ammiano has a 14-year record as SF supervisor that simply can’t be beat now that 8-year term limits have been introduced at the Board. And it will be difficult for other supes to touch his record in terms of legislation, service, attitude, wit and, of course, stark raving popularity.

Recalling Ammiano’s arrival at the Board a decade and a half ago, Peskin said, “Tom was a voice in the wilderness.”

“He managed to got living wage and domestic partnership legislation passed, long before either concept was popular. He succeeded in prevailing on district elections,” Peskin said. “He gave voice to the modern Board of Supervisors—for which I’ll never forgive you, Tom.”

“We love you, we miss you and I’ll come volunteer in your district office, now that I’m not going to have a job come December 8,” Peskin added.

Then it was the turn of Sup. Bevan Dufty, who has sat elbow to elbow with Ammiano for the past two years, to explain why he believes that he had “the best seat in the house.”

According to Dufty, this close proximity helped prevent Ammiano, who also happens to be a wickedly biting stand-up comic, from making jokes about him to the reporters that are corraled directly behind Ammiano in the press box.

Sup. Chris Daly praised Ammiano for ushering in district elections, bringing in a progressive Board and making a historic run for mayor in 1999.

“‘When you get termed out in Sacramento, we’ll be waiting for your return,” Daly promised.

Sup. Michela Alioto-Pier explained why she is going to miss Ammiano a lot.

“We never ever vote together on anything,” Alioto-Pier admitted, describing Ammiano as a “people come first” type.

“You always listen to me, and you’ve given me some of the best advice I’ve gotten since I got here,” Alioto-Pier said, further recalling how Ammiano once screamed at someone, something about, “When you walk a mile in my pumps,” an incident that inspired her to admire this famously flamboyant supervisor even more than ever.

Sup. Mirkarimi recalled how he was working as aide to Sup. Terence Hallinan, when Ammiano was first elected

“Tom really changed the entire climate of this instituion,” Mirkarimi said. “He swifty became the archangel, if you will, of the progressive movement. He is a rain maker, a king maker, a visionary.”

Acknowledging that it’ll be impossible to replace Ammiano’s wit, Mirkarimi suggested that he consider providing courses for would-be politicians.

Sup. Jake McGoldrick said “ Tom Ammiano has changed the world.”

Sup. Carmen Chu found it fitting that Ammiano is going to the State Assembly, since ” he’s such a statesman.”

The wittiest line of the afternoon belonged to Sup. Sean Elsbernd.

“The Board of Supervisors without Tom Ammiano is like the Vatican without the Pope,” Elsbernd said.

And the best warning belonged to Sup. Sophie Maxwell.

Recalling Ammiano’s grace and integrity, his ability to get testy and angry one minute, to lash out and then let matters drop the next, Maxwell said, “Look out Sacramento, they just don’t know what’s coming.”

Then it was Ammiano’s turn to say goodbye.

“It’s been a great time,” he said, recalling how district elections heralded a return to populism and admitting how he has only recently been getting in touch with how much Harvey Milk inspired the city, and how “terrifically special and strong” Milk was.

Calling San Francisco “a crazy indefinable city,” Ammiano said, “Elvis may have left the building, but never the City.” Then, turning to the press box, tears in his eyes, he said, “And thank you, press.”

And then he was gone in a blaze of bouquets and flowery accolades, leaving the running dogs of the press wondering just exactly how we are going to survive Board meetings, without those joking asides that Dufty rightly feared and that Ammiano frequently tossed out for us, like biscuits for naughty puppies that he somehow still manages to love, no matter how many times we chew on his favorite slippers.

Tale of the city

If last week’s extensive Guardian coverage didn’t convince you, here’s my two cents: see Milk. Not that you may have needed convincing; seems like everyone in San Francisco is stoked to see Gus Van Sant’s political biopic, with Sean Penn starring as the first openly gay man elected to public office in America. If you live here, it’s impossible to separate yourself completely from the story — even if you’re too young to remember the history firsthand –- since so much of it is already familiar. There’s City Hall, Milk’s "theater" and the site of his 1978 assassination, along with Mayor George Moscone, by fellow supe Dan White; the Castro District, meticulously made over to mimic Milk’s 1970s; a dog-poopy moment in Duboce Park; and references to everything from district elections to this very newspaper.

Still, even out-of-towners, except bigoted ones, will be moved by Milk. Milk’s experiences allow the film to take a personal look at the struggle for LGBT civil rights in America, with a particular focus on Anita Bryant’s cross-country hate crusade. Scenes showing the triumphant defeat of Prop. 6 — a 1978 proposal to fire all gay teachers and those who supported them — are bittersweet in the wake of the passage of Prop. 8. At times, Van Sant’s film feels eerily timely, down to the spontaneously assembled protests on Castro at Market, and its focus on a politico who believed in hope despite the odds.

But Milk is more than its message — despite its many sober moments, it also manages to be an entertaining film. Thank Van Sant’s steady direction, which (mostly) avoids melodrama and integrates archival footage with seamless ease, and a Penn performance that feels remarkably natural even though he clearly obsessed over perfecting Milk’s voice and mannerisms. Among the supporting players, Emile Hirsch (funny and energetic as activist Cleve Jones) and Josh Brolin (fumbling and creepy as killer White) are standouts. Less successful is Diego Luna as Milk’s needy lover Jack Lira, though it’s not really Luna’s fault; the Lira subplot comes across as distracting, adding unnecessary drama to a story already brimming with compelling conflict. Look for Penn to scoop up mad awards-season praise, all the more deserved if his inspiring turn fires up a new generation to follow in Milk’s footsteps.

Is anyone else appalled that the Obamas are not even considering sending their kids to public schools? Seriously. This may not seem like the most important issue on the president’s agenda, but I think it’s a big deal.

According to The New York Times, Michelle Obama has toured Sidwell Friends, the pricey private school where Chelsea Clinton was educated. She’s also looking at Maret School and Georgetown Day, two institutions that cater to the children of the rich and powerful. There are no public schools on the list.

Adrian Fenty, the mayor of Washington, DC has urged the Obamas to consider the schools that most DC kids attend, but he has little moral suasion: Mayor Fenty’s twin sons go to private school.

I’m a public school parent, and this really bothers me. What the Obamas are saying, in essence, is that there is no public school anywhere in the district good enough for their kids. They’re saying that if you’ve got the money, you should flee for the safety of private academies. Those lowly public places are just for the peasants.

That sort of statement matters. It matters when you think about the new president’s priorities. It matters when you think about the role he wants to play not just as a chief executive but as an agent of change and a moral compass for the nation and the world. In a way, it’s his first test, and he’s flunked it.

I’m sorry: the children of the president should go to public schools. The children of mayors, and city council members, and county supervisors, and city attorneys should go the same schools as the kids of the majority of their constituents. And if those schools aren’t as good as they’d like, well then, join the team. The rest of us are working like hell to make the under-funded, over-stressed public schools better. You can, too.

And by the way, Mr. President-elect, my public school in San Francisco is giving my son and daughter a great education. And they’re growing up with kids who aren’t just like them. That’s worth way more than your fancy $21,000 private school can ever offer.

The election of Sup. Ed Jew two years ago gave ranked-choice voting a bad rep. This year, however, I think we saw how the system can work.

I understand the critics who say that old-fashioned runoffs — second-round elections held a few weeks after the general — are more fair and allow for excitement, like Tom Ammiano vs. Willie Brown in 1999 and Matt Gonzalez vs. Gavin Newsom in 2003. But they also create a problem, particularly when one side has a lot more money than the other.

Downtown had almost endless resources to try to defeat Eric Mar, David Chiu, and John Avalos. The Democratic Party, thanks to the progressive takeover this summer, was supporting the three progressives, as was labor, the Sierra Club, and the Tenants Union. And while party chair Aaron Peskin raised a sizeable sum for slate cards and labor spent cash on organizing efforts, that was dwarfed by the landlords and developers.

Mar, Chiu, and Avalos had the advantage of a high-turnout election. If they’d been forced to run again three weeks later, downtown would have again dumped hundreds of thousands of dollars into the races — and at some point, the good guys would run out of money. Plus, RCV gave the candidates an incentive to make alliances.

Not a perfect system, but better, I think, than the obvious alternative.

The new Harvey Milk movie, which opens later this month, begins as a love story, a sweet love story about two guys who meet in a subway station and wind up fleeing New York for San Francisco. But after that, the movie gets political — in fact, by Hollywood standards, it’s remarkably political.

The movie raises a lot of issues that are alive and part of San Francisco politics today. The history isn’t perfect (see sidebar), but it is compelling. And while we mourn Milk and watch Milk, we shouldn’t forget what the queer hero stood for.

Milk started out as something of a pot-smoking hippie. “The ’70s were a hotbed of everything,” Sup. Tom Ammiano remembered. “Feminism, civil rights, antiwar.” Milk’s early campaigns grew out of that foment. “Sure, he wanted to be elected,” Ammiano told us. “But the main ingredient was courage. He was fighting with the cops when they raided the bars … what he did was dangerous.”

Milk never would have been elected supervisor without district elections — and the story of district elections, and community power, ran parallel to Milk’s own story, for better and for worse.

Milk tried twice to win a seat on the at-large Board of Supervisors and never made the final cut. But in the mid-1970s, a coalition of community leaders, frustrated that big money controlled city policy, began organizing to change the way supervisors were elected. The shift from an at-large system to a district one in 1976 was a transformational moment for the city.

“I think that San Francisco doesn’t always appreciate the sea change that district elections brought,” Cleve Jones, a queer activist and friend of Milk who helped Dustin Black write the script for Milk, told us. “It wasn’t just important to the various communities that had been locked out of power at City Hall — it was the glue that began to grow the coalitions.”

Milk was elected as part of what became the most diverse board in the city’s history, with Asian, black, and gay representatives who came out of community organizations. The board, of course, also included Dan White, a conservative Irish Catholic and former cop. And it was the assassination of Milk and Mayor George Moscone by Sup. White — and the civic heartbreak, chaos, and confusion that followed — that allowed downtown forces to repeal district elections in 1980. That gave big money and big business control of the board for another 20 years, a reign that ended only when district elections returned in 2000.

Milk was a gay leader, but he was also a tenant activist, public power supporter, advocate for police reform, supporter of commuter taxes on downtown workers, and coalition-builder who helped bring together the labor movement and the queer community. It started, ironically, with the Teamsters.

“Those of us who came out of the antiwar movement remembered that the Teamsters supported Richard Nixon until the very last moment,” Jones said. “And they were seen as one of the most homophobic of all the unions.”

But in the 1970s, the Teamsters were at war with the Coors Brewing Company, and trying to get San Francisco bars to stop serving Coors beer. Allan Baird, a Teamsters leader who lived in the Castro District, saw an opportunity and contacted Milk, who agreed to help — if the Teamsters would start hiring gay truck drivers.

“It wasn’t just San Francisco and California,” Jones recalled. “We got Coors beer out of every gay bar in North America.” And gays started driving beer trucks.

Today, the queer-labor alliance is one of the most powerful, effective, and lasting political forces in San Francisco.

Milk was never popular among the wealthier and more established sectors of the gay community; he believed in a populist brand of politics that wasn’t afraid to take the fight to the streets — and beyond San Francisco. A central theme of the film is the fight against Proposition 6, a 1978 measure by conservative state Sen. John Briggs that would have barred homosexuals from teaching the public schools.

Milk, defying the mainstream political strategists, insisted on debating Briggs in some of the most right-wing parts of the state. He refused to downplay the gay-rights issues. And when Prop. 6 went down, it was the end of that particular homophobic crusade.

Milk was always an outsider, and he ran for office as a foe of the Democratic Party machine. “His campaign for state Assembly was all about Harvey vs. the machine,” former Sup. Harry Britt told us. “His main supporter was [Sup.] Quentin Kopp. He didn’t run as the liberal in the race; he ran against the machine.” And for much of the next 20 years, progressives in San Francisco found themselves fighting what became the Brown-Burton machine, controlled by Willie Brown and John Burton.

It’s too bad the movie wasn’t released early enough to have had an impact on Prop. 8, the anti same-sex marriage measure that just passed in California. Some critics of the No on 8 campaign say the message was far too soft, and that a little Harvey-Milk-style campaigning might have helped.

But for us, one of the most striking things about the movie is the fact that Milk and his lover, Scott Smith, were able to leave New York with very little money, arrive in San Francisco, rent an apartment on their unemployment checks, and open a camera store. That wouldn’t be possible today; the Harvey Milks of 2008 can’t live in the Castro — and many can’t live anywhere in San Francisco. The city is too expensive.

In fact, for all the victories Milk won, for all the successes of the movement he helped to build, much of his agenda is still unfulfilled, even in his hometown.

The first time Harvey Milk gives a public speech in the film, he’s standing on a soapbox … literally. He brings out a box with “soap” written on the side; a funny gag, but a serious and telling moment for him and San Francisco.

The issues that Milk spoke so passionately about in that speech included police reform, ending the war on drugs, protecting tenants and controlling rents, and improving parks and protecting people’s rights to use them liberally — all issues with as much resonance today as they had back then.

The movie leaves us with a painful question. For all the celebration of Milk’s legacy by San Franciscans of various political stripes, why have we made so little progress on some of his signature issues? We celebrate the martyr — but often forget what the man really advocated.

Support for gay rights is de rigueur for anyone who aspires to public office in San Francisco. But a quarter of city residents still voted to take away same-sex marriage rights in this election. Many older gay men today are barely able afford their AIDS medication and rent. And transgender people and other nontraditional types are still ostracized, unable to get good jobs, and sometimes treated contemptuously when they seek help from their government.

Sure, marijuana is supposedly legal for medical uses in California and pot clubs proliferate around San Francisco. But even these sick patients are still targeted by the federal government and its long arms in San Francisco, including former US Attorney Kevin Ryan, whom Mayor Gavin Newsom named his top crime advisor and who is now seeking to crackdown on the pot clubs. Why, 30 years after Milk was shot, does one have to claim an ailment or illness to smoke a joint in this town?

Two-thirds of city residents are renters, a group Milk championed with gusto, but we barely beat a state initiative in June that would have abolished rent control. Housing is getting steadily more expensive. And in this election, Newsom and his downtown allies opposed Proposition B, an affordable housing measure, and Proposition M, a common sense measure to prohibit landlords from harassing their tenants. Such harassment is a common tactic to force tenants from rent-controlled units, even though the City Attorney’s Office is currently suing the city’s biggest landlord, Skyline Realty, for its well-documented history of harassment. Newsom may be the champion of same-sex marriage, but when it comes to issues like tenants’ rights, we suspect that Milk would be appalled at Newsom’s gall.

Ted Gullicksen of the San Francisco Tenants Union noted that in the wake of Milk’s death and before the repeal of district elections, San Francisco established rent control and limits on condo conversions. The tenant movement has grown steadily stronger and more sophisticated, he said, as it had to in order to counter increasing economic and political pressures and creative gambits by landlords.

“The city has gentrified phenomenally since that time, and that’s put tremendous pressure on tenants and on condo conversions,” Gullicksen told us. “It continues to be a real struggle.”

Police reform was also a huge issue for Milk and his gay contemporaries, who suffered more than most groups from the behavior of thuggish cops protected by weak oversight rules and a powerful union. And today, the Police Officers Association is stronger and meaner than ever, but the oversight has improved little, as both the Guardian and San Francisco Chronicle have explored with investigations in recent years.

And in our public parks, San Francisco officials in recent years have banned smoking cigarettes, drinking alcohol, playing amplified music, and even gathering in large numbers without expensive, restrictive permits. Even in the Castro, where Milk and his allies took it as a basic right to gather in the streets, Newsom and the NIMBYs unilaterally cancelled Halloween celebrations and used police to chase away citizens with water trucks.

Is this really the city Harvey Milk was trying to create? In the film, he talks about transforming San Francisco into a vibrant, tolerant beacon that would set an example for the rest of the country, telling his compatriots, “We have got to give them hope.”

Well, with hope now making a comeback, perhaps San Francisco can finally follow Milk’s lead on the issues he cared about most.

I remember Harvey

Toward the end of the supervisorial campaign in 1973, I got an intercom call from Nancy Destefanis, our advertising representative handling political ads. Hey, she said, I got a guy here by the name of Harvey Milk who is running for supervisor and I think you ought to talk to him.

Milk? I replied. How can anybody run for supervisor with the name of Milk?

Nancy laughed and said that wasn’t his big problem, it was that he was running as an openly gay candidate, but he had strong progressive positions and potential. Nancy, a former organizer for Cesar Chavez’ farm workers, was tough and savvy, and I always took her advice seriously. "Send him in," I said.

And so Harvey Milk came into my office, at the start of his political career, looking like a well-meaning amateur. He had a ponytail and mustache, wore Levi’s and a T-shirt, and talked breathlessly about his issues without a word about how he intended to win. His arguments were impressive, but he clearly was not ready for prime time. We gave him our "romantic" endorsement. He got 17,000 votes.

I also advised him, as diplomatically as I could, that if he wanted to be a serious candidate, he needed to clean up his act.

Two years later, Milk strode into the Guardian in a suit and tie as a serious candidate ready to win and lead. As our strong endorsement put it, "Now he’s playing politics for real: he’s shaved his mustache, is running hard in the voting areas of the Sunset, and has picked up a flock of seemingly disparate endorsements from SF Tomorrow, the Building and Trades Council, Teamsters (for his work on the Coors beer boycott) and the National Women’s Caucus." On policy, we said he "would put his business acumen to work dissecting the budget" and "would fight for higher parking taxes, no new downtown garages, a graduated real estate transfer tax, an end to tax exemptions for banks and insurance companies, dropping the vice squad from the police budget, and improved mental health care facilities." He couldn’t get enough votes citywide to win, but he came closer.

In 1976, Milk decided to run for a state Assembly seat against Art Agnos. We decided to go with Agnos, largely because he was familiar with Sacramento as an aide to former assemblyman Leo McCarthy and also because our political reporter covering the race, Jerry Roberts, said that Agnos was much better on Sacramento issues during the campaign. We decided that Agnos was right for Sacramento and that we needed Milk in San Francisco. I have often wondered if we had endorsed Milk, and he had won, if he would still be alive.

The next year, when the city shifted to district supervisorial elections, Milk won and became the first openly gay elected official in the country. He would always say, "I am not a gay supervisor, I am a supervisor who happens to be gay."

On the afternoon of Friday, Nov. 24, 1978, Milk dropped by to see me at the Guardian. He was a bit dejected. Things were getting tougher for him on the board. He was getting hassled by his friends and allies who were telling him, as he put it, "if you don’t vote for me on this one, I’m going to stop supporting you." He said he was going to press on, but from then on he was going to work more closely with the Guardian on legislation and on giving us information.

Then he smiled the famous Harvey Milk smile and said as he left my room, "I want to be your Deep Throat at City Hall."

Those were the last words I ever heard from Harvey Milk. He was assassinated three days later.

The people’s election

By midnight Nov. 4, the drama was long over: John McCain had conceded, Barack Obama had delivered his moving victory speech — declaring that “change has come to America” — and the long national nightmare of the Bush years was officially headed for the history books.

But in San Francisco, the party was just getting started.

Outside of Kilowatt, on 16th Street near Guerrero, the crowd of celebrants was dancing to the sounds of a street drummer. In the Castro District, a huge crowd was cheering and chanting Obama’s name. And on Valencia and 19th streets, a spontaneous outpouring of energy filled the intersection. Two police officers stood by watching, and when a reporter asked one if he was planning to try to shut down the celebration and clear the streets, he smiled. “Not now,” he said. “Not now.”

Then, out of nowhere, the crowd began to sing: O say can you see /By the dawn’s early light …

It was a stunning moment, as dramatic as anything we’ve seen in this city in years. In perhaps the most liberal, counterculture section of the nation’s most liberal, counterculture city, young people by the hundreds were proudly singing The Star Spangled Banner. “For the first time in my life,” one crooner announced, “I feel proud to be an American.”

Take that, Fox News. Take that Sean Hannity and Rush Limbaugh and Sarah Palin and the rest of the right-wing bigots who have tried to claim this country for themselves. On Nov. 4, 2008, progressives showed the world that we’re real Americans, too, proud of a country that has learned from its mistakes and corrected its course.

President Obama will let us down soon enough; he almost has to. The task at hand is so daunting, and our collective hopes are so high, that it’s hard to see how anyone could succeed without a few mistakes. In fact, Obama already admitted he won’t be “a perfect president.” And when you get past the rhetoric and the rock star excitement, he’s taken some pretty conservative positions on many of the big issues, from promoting “clean coal” and nuclear power to escautf8g the war in Afghanistan.

But make no mistake about it: electing Barack Obama was a progressive victory. Although he never followed the entire progressive line in his policy positions, he was, and is, the creature of a strong progressive movement that can rightly claim him as its standard-bearer. He was the candidate backed from the beginning by progressives like Supervisors Chris Daly and Ross Mirkarimi (a Green). And only after his improbable nomination did moderates like Mayor Gavin Newsom and Sen. Dianne Feinstein jump on the bandwagon.

From the start, the young, activist, left wing of the Democratic Party was the driving force behind the Obama revolution. And while he has always talked to the Washington bigwigs — and will populate his administration with many of them — he would never have won without the rest of us. And that’s a fact of political life it will be hard for him to ignore, particularly if we don’t let him forget it.

For a few generations of Americans — everyone who turned 18 after 1964 — this was the first presidential election we’ve been able to get truly excited about. It was also the first presidential election that was won, to a significant extent, on the Internet, where progressive sites like dailykos.com raised millions of dollars, generated a small army of ground troops, and drove turnout in both the primaries and the general election. The movement that was built behind Obama can become a profound and powerful force in American politics.

So this was, by any reasonable measure, the People’s Election. And now it’s the job of the people to keep that hope — and that movement — alive, even when its standard-bearer doesn’t always live up to our dreams.

The evidence that this was the People’s Election wasn’t just at the national level. It showed up in the results of the San Francisco elections as well.

This was the election that would demonstrate, for the first time since the return of district elections, whether a concerted, well-funded downtown campaign could trump a progressive grassroots organizing effort. Sure, in 2000, downtown and then-Mayor Willie Brown had their candidates, and the progressives beat them in nearly every race. But that was a time when the mayor’s popularity was in the tank, and San Franciscans of all political stripes were furious at the corruption in City Hall.

“In 2000, I think a third of the votes that the left got came from Republicans,” GOP consultant Chris Bowman, who was only partially joking, told us on election night.

This time around, with the class of 2000 termed out, a popular mayor in office and poll numbers and conventional wisdom both arguing that San Franciscans weren’t happy with the current Board of Supervisors (particularly with some of its members, most notably Chris Daly), many observers believed that a powerful big-money campaign backing some likable supervisorial candidates (with little political baggage) could dislodge the progressive majority.

As late as the week before the election, polls showed that the three swings districts — 1, 3, and 11 — were too close to call, and that in District 1, Chamber of Commerce executive Sue Lee could be heading for a victory over progressive school board member Eric Mar.

And boy, did downtown try. The big business leaders, through groups including the Committee on Jobs, the Chamber, the Association of Realtors, Plan C, the newly-formed Coalition for Responsible Growth, and the Building Owners and Managers Association, poured more than $630,000 into independent expenditures smearing progressive candidates and promoting the downtown choices. Newsom campaigned with Joe Alioto, Jr. in District 3 and Ahsha Safai in District 11. Television ads sought to link Mar, John Avalos, and David Chiu with Daly.

Although the supervisors have no role in running the schools, the Republicans and downtown pushed hard to use a measure aimed at restoring JROTC to the city’s high schools as a wedge against the progressives in the three swing districts. They also went to great lengths — even misstating the candidates’ positions — to tar Mar, Chiu, and Avalos with supporting the legalization of prostitution.

And it didn’t work.

When the votes were counted election night, it became clear that two of the three progressives — Avalos and Chiu — were headed for decisive victories. And Mar was far enough ahead that it appeared he would emerge on top.

How did that happen? Old-fashioned shoe leather. The three campaigns worked the streets hard, knocking on doors, distributing literature, and phone banking.

“I’ve been feeling pretty confident for a week,” Avalos told us election night, noting his campaign’s strong field operation. As he knocked on doors, Avalos came to understand that downtown’s attacks were ineffective: “No one bought their horseshit.”

A few weeks earlier, he hadn’t been so confident. Avalos said that Safai ran a strong, well-funded campaign and personally knocked on lots of doors in the district. But ultimately, Avalos was the candidate with the deepest roots in the district and the longest history of progressive political activism.

“This is really about our neighborhood,” Avalos told us at his election night party at Club Bottom’s Up in the Excelsior District. “It was the people in this room that really turned it around.”

The San Francisco Labor Council and the tenants’ movement also put dozens of organizers on the ground, stepping up particularly strongly as the seemingly coordinated downtown attacks persisted. “It was, quite literally, money against people, and the people won,” Labor Council director Tim Paulson told us.

Robert Haaland, a staffer with the Service Employees International Union and one of the architects of the campaign, put it more colorfully: “We ran the fucking table,” he told us election night. “It’s amazing — we were up against the biggest downtown blitz since district elections.”

The evidence suggests that this election was no anomaly: the progressive movement has taken firm hold in San Francisco, despite the tendency of the old power-brokers — from Newsom to downtown to both of the city’s corporate-owned daily newspapers — to try to marginalize it.

Political analyst David Latterman of Fall Line Analytics began the Nov. 5 presentation at the San Francisco Planning and Urban Research Association election wrap-up by displaying an ideologically-coded map of San Francisco, drawing off of data from the Progressive Voter Index that he developed with San Francisco State University political science professor Rich de Leon. The PVI is based on how San Francisco residents in different parts of the city vote on bellwether candidates and ballot measures.

“Several of the districts in San Francisco discernibly moved to the left over the last four to eight years,” Latterman told the large crowd, which was made up of many of San Francisco’s top political professionals.

The two supervisorial districts that have moved most strongly toward the progressive column in recent years were Districts 1 (the Richmond) and 11 (the Excelsior), which just happened to be two of the three swing districts (the other being District 3–North Beach and Chinatown) that were to decide the balance of power on the Board of Supervisors this election.

Latterman said Districts “1, 3, and 11 went straight progressive, and that’s just the way it is.”

In fact, in many ways, he said this was a status-quo election, with San Francisco validating the progressive-leaning board. “A lot of people in the city didn’t see it as a chance for a drastic change citywide.”

In other words, keeping progressives in City Hall has become a mainstream choice. Whatever downtown’s propaganda tried to say, most San Franciscans are happy with a district-elected board that has brought the city a living-wage law and moved it a step toward universal health insurance.

The fate of the local ballot measures was another indication that Newsom, popular as he might be, has little ability to convince the voters to accept his policy agenda.

Voters rejected efforts by Newsom to consolidate his power, rejecting his supervisorial candidates, his Community Justice Center (as presented in Measure L), and his proposed takeover of the Transportation Authority (soundly defeating Proposition P) while approving measures he opposed, including Propositions M (protecting tenants from harassment) and T (Daly’s guarantee of substance abuse treatment on demand).

Asked about it at a post-election press conference, Newsom tried to put a positive spin on the night. “Prop. A won, and I spent three years of my life on it,” he said. “Prop B. was defeated. Prop. O, I put on the ballot. I think it’s pretty small when you look at the totality of the ballot.” He pointed out that his two appointees — Carmen Chu in District 4 and Sean Elsbernd in District 7 — won handily but made no mention of his support for losing candidates Lee, Alicia Wang, Alioto, Claudine Cheng, and Safai.

“You’ve chosen two as opposed to the totality,” Newsom said of Props. L and P. “Prop. K needed to be defeated. Prop. B needed to be defeated.”

Yet Newsom personally did as little to defeat those measures as he did to support the measures he tried to claim credit for: Measures A (the General Hospital rebuild bond, which everyone supported) and revenue-producing Measures N, O, and Q. In fact, many labor and progressives leaders privately grumbled about Newsom’s absence during the campaign.

Prop. K, which would have decriminalized prostitution, was placed on the ballot by a libertarian-led signature gathering effort, not by the progressive movement. And Prop. B, the affordable housing set-aside measure sponsored by Daly, was only narrowly defeated — after a last-minute attack funded by the landlords.

All three revenue-producing measures won by wide margins. Prop. Q, the payroll tax measure, passed by one of the widest margins — 67-33.

Latterman and Alex Clemens, owner of Barbary Coast Consulting and the SF Usual Suspects Web site, were asked whether downtown might seek to repeal district elections, and both said it didn’t really matter because people seem to support the system. “I can’t imagine, short of a tragedy, district elections going anywhere,” Latterman said.

Clemens said that while downtown’s polling showed that people largely disapprove of the Board of Supervisors — just as they do most legislative bodies — people generally like their district supervisor (a reality supported by the fact that all the incumbents were reelected by sizable margins).

“It ain’t a Board of Supervisors, it is 11 supervisors,” Clemens said, noting how informed and sophisticated the San Francisco electorate is compared to many other cities. “When you try to do a broad-based attack, you frequently end up on the wrong end (of the election outcome).”

We had a bittersweet feeling watching the scene in the Castro on election night. While thousands swarmed into the streets to celebrate Obama’s election, there was no avoiding the fact that the civil-rights movement that has such deep roots in that neighborhood was facing a serious setback.

The Castro was where the late Sup. Harvey Milk started his ground-breaking campaign to stop the anti-gay Briggs Initiative in 1978. Defying the advice of the leaders of the Democratic Party, Milk took on Briggs directly, debating him all over the state and arguing against the measure that would have barred gay and lesbian people from teaching in California’s public schools.

The defeat of the Briggs Initiative was a turning point for the queer movement — and the defeat of Prop. 8, which seeks to outlaw same-sex marriage, should have been another. Just as California was the most epic battle in a nationwide campaign by right-wing bigots 30 years ago, anti-gay marriage measures have been on the ballot all over America. And if California could have rejected that tide, it might have taken the wind out of the effort.

But that wasn’t to be. Although pre-election polls showed Prop. 8 narrowly losing, it was clear by the end of election night that it was headed for victory.

Part of the reason: two religious groups, the Catholics and the Mormons, raised and spent some $25 million to pass the measure. Church-based groups mobilized a reported 100,000 grassroots volunteers to knock on doors throughout California. Yes on 8 volunteers were as visible in cities throughout California as the No on 8 volunteers were on the streets of San Francisco, presenting a popular front that the No on 8 campaign’s $35 million in spending just couldn’t counter — particularly with so many progressive activists, who otherwise would have been walking precincts to defeat Prop. 8, fanned out across the country campaigning for Obama.

“While we knew the odds for success were not with us, we believed Californians could be the first in the nation to defeat the injustice of discriminatory measures like Proposition 8,” a statement on the No on Prop. 8 Web site said. “And while victory is not ours this day, we know that because of the work done here, freedom, fairness, and equality will be ours someday. Just look at how far we have come in a few decades.”

San Francisco City Attorney Dennis Herrera, joined by Los Angeles City Attorney Rocky Delgadillo and Santa Clara County Counsel Ann C. Raven, filed a legal challenge to Prop. 8, arguing that a ballot initiative can’t be used to take away fundamental constitutional rights.

“Such a sweeping redefinition of equal protection would require a constitutional revision rather than a mere amendment,” the petition argued.

“The issue before the court today is of far greater consequence than marriage equality alone,” Herrera said. “Equal protection of the laws is not merely the cornerstone of the California Constitution, it is what separates constitutional democracy from mob rule tyranny. If allowed to stand, Prop. 8 so devastates the principle of equal protection that it endangers the fundamental rights of any potential electoral minority — even for protected classes based on race, religion, national origin, and gender.”

That may succeed. In fact, the state Supreme Court made quite clear in its analysis legalizing same-sex marriage that this was a matter of fundamental rights: “Although defendants maintain that this court has an obligation to defer to the statutory definition of marriage contained in [state law] because that statute — having been adopted through the initiative process — represents the expression of the ‘people’s will,’ this argument fails to take into account the very basic point that the provisions of the California Constitution itself constitute the ultimate expression of the people’s will, and that the fundamental rights embodied within that Constitution for the protection of all persons represent restraints that the people themselves have imposed upon the statutory enactments that may be adopted either by their elected representatives or by the voters through the initiative process.

As the United States Supreme Court explained in West Virginia State Board of Education vs. Barnette (1943) 319 U.S. 624, 638: ‘The very purpose of a Bill of Rights was to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials and to establish them as legal principles to be applied by the courts. One’s right to life, liberty, and property, to free speech, a free press, freedom of worship and assembly, and other fundamental rights may not be submitted to vote; they depend on the outcome of no elections.'”

As Board of Supervisors President Aaron Peskin told the Guardian later that week: “Luckily, we have an independent judiciary, because the voters of California have mistakenly taken away a class of civil rights.”

But if that legal case fails, this will probably wind up on the state ballot again. And the next campaign will have to be different.

There already have been many discussions about what the No on 8 campaign did wrong and right, but it’s clear that the queer movement needs to reach out to African Americans, particularly black churches. African Americans voted heavily in favor of Prop. 8, and ministers in many congregations preached in favor of the measure.

But there are plenty of black religious leaders who took the other side. In San Francisco the Rev. Amos Brown, who leads the Third Baptist Church, one of the city’s largest African American congregations, spoke powerfully from the pulpit about the connections between the civil rights struggles of the 1960s and the fight for same-sex marriage.

The next time this is on the ballot, progressive and queer leaders will need to build a more broad-based movement. That is not only possible, but almost inevitable.

The good news — and it’s very good news — is that (as Newsom famously proclaimed) same-sex marriage is coming, whether opponents like it or not. That’s because the demographics can’t be denied: the vast majority of voters under 30 support same-sex marriage. This train is going in only one direction, and the last remaining issue is how, and when, to make the next political move.

The progressives didn’t win everything in San Francisco. Proposition H, the Clean Energy Act, was taken down by one of the most high-priced and misleading campaigns in the city’s history. Pacific Gas and Electric Co. spent more than $10 million telling lies about Prop. H, and with the daily newspapers virtually ignoring the measure and never challenging the utility’s claims, the measure went down.

“This was a big, big, big money race,” Latterman said. “In San Francisco, you spend $10 million and you’re going to beat just about anything.”

But activists aren’t giving up on pushing the city in the direction of more renewable energy (see Editorial).

Latterman said the narrow passage of Prop. V, which asked the school board to consider reinstating JROTC, wasn’t really a victory. “I would not call this a mandate. I worked with the campaign, and they weren’t looking for 53 percent. They were looking for 60-plus percent,” Latterman said. “I think you’ll see this issue just go away.”

Neither Latterman nor Clemens would speculate on who the next president of the Board of Supervisors will be, noting that there are just too many variables and options, including the possibility that a newly elected supervisor could seek that position.

At this point the obvious front-runner is Ross Mirkarimi, who not only won re-election but received more votes than any other candidate in any district. Based on results at press time, more than 23,000 people voted for Mirkarimi; Sean Elsbernd, who also had two opponents, received only about 19,000.

Mirkarimi worked hard to get Avalos, Chiu, and Mar elected, sending his own volunteers off to those districts. And with four new progressives elected to the board, joining Mirkarimi and veteran progressive Chris Daly, the progressives ought to retain the top job.

Daly tells us he won’t be a candidate — but he and Mirkarimi are not exactly close, and Daly will probably back someone else — possibly one of the newly elected supervisors.

“It’s going to be the most fascinating election that none of us will participate in,” Clemens said.

The danger, of course, is that the progressives will be unable to agree on a candidate — and a more moderate supervisor will wind up controlling committee appointments and the board agenda.

One of the most important elements of this election — and one that isn’t being discussed much — is the passage of three revenue-generating measures. Voters easily approved a higher real-estate transfer tax and a measure that closed a loophole allowing law firms and other partnerships to avoid the payroll tax. Progressives have tried to raise the transfer tax several times in the past, and have lost hard-fought campaigns.

That may mean that the anti-tax sentiment in the city has been eclipsed by the reality of the city’s devastating budget problems. And while Newsom didn’t do much to push the new tax measures, they will make his life much easier: the cuts the city will face won’t be as deep thanks to the additional $50 million or so in revenue.

It will still be a tough year for the new board. The mayor will push for cuts that the unions who supported the newly elected progressives will resist. A pivotal battle over the city’s future — the eastern neighborhoods rezoning plan — will come before the new board in the spring, when the recent arrivals will barely have had time to move into their offices.

Obama, of course, will face an even tougher spring. But progressives can at least face the future knowing that not only could it have been a lot worse; for once things might be about to get much better.

CFAC: Court did its job on Prop. 8

Although its name did not even appear on the ballot, the California Supreme Court was perhaps the state’s biggest loser in Tuesday’s historic elections. The voters’ narrow approval of Proposition 8 effectively reverses the high court’s controversial decision earlier this year, which extended the right to marry to same-sex couples.

The court knew the risks. The statute it declared unconstitutional in In re Marriage Cases was itself the result of a statutory state ballot initiative in 2000. In overturning that assertion of popular will, the court no doubt realized it was setting the stage for a further confrontation in which opponents of gay marriage would try to override the court’s decision through the initiative process, this time amending the state constitution.

Critics will say that Chief Justice Ron George’s Supreme Court is guilty of overreaching – that, by interceding in a political and cultural struggle, the court has suffered a loss of prestige and
institutional authority. But while it’s clear, in hindsight, that the George court miscalculated the depth of opposition to gay marriage in the blue state of California, that does not mean the court’s landmark decision in In re Marriage Cases was a mistake.

For one thing, California’s gay-marriage battle is not over. Proposition 8 is still subject to challenge under the U.S. Constitution for, among other things, its selective cancellation of a
previously granted substantive right. Although a decision founded in federal law would be subject to review in the U.S. Supreme Court, there is no certainty the federal high court would elect to decide the case – or, if it did, that it would end up sustaining Proposition 8.

Proposition 8 is also subject to challenge under the California Constitution, even though the proposition is itself a constitutional amendment. This is so because, although the voters can, through the initiative process, add language to the constitution, it is the responsibility of the California Supreme Court to interpret new constitutional language – and, where necessary, to reconcile it with other, equally valid yet potentially conflicting, constitutional directives.

In the latter category is the most important aspect of In re Marriage Cases: the George court’s decision to analyze legal classifications based on sexual preference under the same rigorous standard of “strict scrutiny” usually reserved for classifications based on race, religion or ethnicity. This portion of the court’s decision is not altered by Proposition 8, and it will be front and center in any litigation against Proposition 8 under state law. While the courts can’t void Proposition 8 on this basis, applying strict scrutiny to Proposition 8’s language is likely to yield a prohibition against gay marriage that is much weaker than the measure’s authors and
supporters intended.

But even if the state Supreme Court takes neither of these paths, leaving Proposition 8 intact (at least until a new electoral majority, in another ballot initiative, repeals it), the court is to be applauded for attempting to resolve a pressing social question – whether to allow gays and lesbians to marry – that the other branches of government had proved incapable of addressing.

In this area and others, it falls to the George court to fill a widening governance gap created by a Legislature that is paralyzed by political divisions and a governor who, despite Arnold
Schwarzenegger’s forceful personality, has little real power compared with other chief executives. (Imagine a federal government in which the attorney general and other top executive branch officials are not appointed by, or answerable to, the president.)

When elected representatives don’t act, the people do, taking the law into their own hands through ballot initiatives, Proposition 8 being only the most recent major example. In this process of direct democracy, an assertive, even activist, Supreme Court is necessary to guard against excesses and to protect the rights of groups disfavored by the majority.

It was in this capacity that the George court, to its credit, issued its decision in In re Marriage Cases, establishing a constitutionally based right to same-sex marriage. Although Proposition 8 is clearly a setback for the court, the damage done to the court’s authority, while considerable, will not be permanent.

The city’s election update: D1 tightens

The San Francisco Department of Elections has counted a bunch more ballots, and has run its first pass at ranked-choice voting. The good news is that the races in districts 3 and 11 are still solid — John Avalos and David Chiu are well ahead.

But District One has tightened a bit. Eric Mar is at 51.6 to 48.3 for Sue Lee. And since Lee won the absentees, this one could get even closer. The problem is that downtown ran a two-person strategy, attacking Mar and urging votes for Lee and Alicia Wang — so a lot of Wang’s seconds are going to Lee. So far, so good, though.

The other interesting twist is the school board race, where Jill Wynns, the longtime incumbent who appeared about to lose her seat, is now back in the running. Norman Yee is far ahead in the lead, followed by Sandy Fewer. Rachel Norton is the next in line, narrowly ahead of Wynns, who is narrowly ahead of Bobbi Lopez. We’ll watch this one closely.

The uncounted ballots

So there are still a huge number of uncounted ballots at City Hall. No surprise there — we knew that was coming on election night.

And in most races, it won’t make much of a difference. But in some, like Prop. B, the outcome might change.

Here’s the problem: San Francisco is rapidly becoming a vote-by-mail town. That’s okay; in Oregon, all ballots are cast by mail. But we are operating as if this were still an earlier time, when almost everyone went to the polls on Election Day. If we are going to be voting differently, and we clearly are, the Department of Elections needs to change with the times.

There’s no reason why absentee ballots can’t be counted as they come in, so that when the polls close, most of those results will be immediately available. It’s not as if DOE is incompetant; the department has made great strides under John Arnst. But the supervisors should put this on the agenda for next year: How do we shift priorities and funding to handle modern elections?

(Oh, and the DOE could run the RCV tally on Election Night, too. It’s not hard.)

(Oh, and will somebody — maybe Aaron Peskin or Tom Ammiano, as a parting gift to all of us as they leave the board — please, please figure out how to get WiFi on Election Night in the North Light Court, where all the reporters are trying to post results and there is no Internet access at all? That room and the Board Chambers. I will volunteer to raise money to buy the router myself, and Alex Clemens has promised he will personally install it. Just show us where to plug the cable in.)

Can’t wait for the city’s official RCV results? Neither could I. Steve Hill of the New America Foundation is unhappy that the city is waiting until Friday afternoon to run the RCV program, expecially since all the information you need to run it is now available — and public.

So Caleb Kleppner, one of Hill’s allies in the voting-reform movement, did the work himself. Here’s Hill’s message:

Attached to this email are the PRELIMINARY RCV results, as a result of running the tabulation on the ballot images posted on the Department of Elections website at 4:30 today. The tabulation was run by Caleb Kleppner of True Ballot (caleb@trueballot.com). The download of the ballot image zip file took about 30 seconds.

Mr. Kleppner then converted the ballot images into input files using a software program and then ran all the tallies on another program called Choice Plus Pro. Mr. Kleppner tells me that he ran the results for all four races in about 12 minutes, which shows you how easy it is to do (which means Sequoia could have done the same thing on election night, or Wednesday, or today, if Director Arntz had instructed them to do so. In fact, according to the file on the web, the Department of Elections produced the master file that defined all the candidates and elections at 11:47 am PT this morning and the ballot image file at 2:47 pm. At that point it would have been a simple additional step – just a few keystrokes on the computer – to run the tabulation, and twelve minutes later they would have had all the results. It’s really that simple).

Here are the usual words of caution for any election: These are PRELIMINARY results. Just as any other election has preliminary results, so do RCV races. I have been told that there are still approximately 110,000 absentee and provisional ballots to process, so for any races that are extremely close (whether RCV or non-RCV) it’s always good to keep in mind that preliminary results are not final results, and results can change. RCV is no different in that way than any other type of electoral method.

The results from this prelim run: Mar in D1, Chiu in D3, Campos in D9 and Avalos in D11. I don’t think the absentees will change much.

Again: I didn’t run this program, and I can’t vouch for the accuracy of the results. But I can vouch for Steve and Caleb, so this is at least worth perusing.
