Three weeks before the June 25-26 Pride Weekend — which is the unofficial opening of the official fall mayoral race — there are two front-runners: state Sen. Leland Yee and Sup. John Avalos.

I’m not saying either is going to win. Things change quickly in this town. We don’t even know for sure if the incumbent, Ed Lee, is going to be in the final scrum.

But here’s what we do know: Yee and Avalos — right now, today — are doing the things they need to do to emerge from a crowded pack. And the others are either hanging back or flailing around.

Avalos had more than 400 people at his kickoff. State Assemblymember Tom Ammiano was there to endorse him. He’s got window signs all over the east side of town. He’s showing momentum, energy; he’s on track to solidify the progressive base and start moving west. He has agreed to cosponsor the mayor’s pension reform plan (but only if SEIU Local 1021 gets the amendments the union wants).

Yee has figured out a very smart strategy: He realizes that he’s already got name recognition and a west-side base, that he’s never going to get the support of the Chinatown establishment (powerbroker Rose Pak hates him), and that he’s one of at least five candidates fighting over the center. So he’s trying to grab a share of the left.

Yee’s people were thrilled that he and Avalos got the Sierra Club. The more groups that endorse the two together (in any order), the more Yee becomes associated with the progressive standard-bearer. And the more second-place votes he gets on the left. (Don’t kid yourself; this race may well come down to who gets second-place votes on the left.)

And Sup. David Chiu just gave Yee a great big gift. Chiu defied every single tenant group in town and became the swing vote in favor of the Parkmerced project. Now the tenants are pissed — and you know Yee is going to try to take advantage of it.

The frustrating part of that scenario is that Yee was never a good tenant vote when he was a supervisor. That’s his Achilles’ heel on the left — but it’s old history, and the anger at Chiu is here today.

Would Chiu be a better mayor for tenants than Yee? Quite possibly. Is any tenant group thinking that right now? No.

Chiu’s in a tricky spot. He’s trying to be the centrist progressive — and that’s a hard thing to sell to either the center (where he’s one of five candidates) or the left (where Yee is edging him out in cozying up to Avalos).

City Attorney Dennis Herrera hasn’t recovered from the political consultant lobbying mess (not a new story, he’s hardly the only, or even remotely, the worst offender, but damn, it makes him look bad). Former Sup. Bevan Dufty’s doing great at the candidate forums but doesn’t have a breakout move. Assessor Phil Ting is awfully quiet.

It’s only June. But it won’t be “only” anything much longer.

Mayor Ed Lee’s pension reform proposal was unveiled May 24 with support from some of those who helped develop it, including investment banker Warren Hellman, Rebecca Rhine from the Municipal Executives Association, San Francisco Chamber of Commerce head Steve Falk, and San Francisco Labor Council Executive Director Tim Paulson.

The plan would dramatically alter the way the city manages employee retirement benefits, starting July 2012, while exempting employees who earn less than $50,000. Lee described it as “serious,” “comprehensive,” and a plan that “reflects consensus.”

Already the legislation to place it on the fall ballot has secured the cosponsorship of Board President David Chiu and Sup. John Avalos, rival candidates for mayor. Other mayoral candidates also offered their support, including former Sup. Bevan Dufty and City Attorney Dennis Herrera.

But there is one notable exception to the support for this plan, a party that has been at the negotiating table where it was crafted: Service Employees International Union Local 1021, which represents about half of the city’s 26,000 employees. The union claims the plan disproportionately affects 500 SEIU members, who are mostly women and people of color and already took large pay cuts last year to avoid layoffs.

Avalos, who described Lee’s proposal as “a sensible approach” and “the right way to go,” has said that if SEIU’s concerns aren’t adequately addressed, he’ll withdraw his sponsorship.

“I’d like to get to a consensus, but if we don’t and 10,000 union workers don’t sign on, I’m going to take my name off as a sponsor,” Avalos said. “We have to find ways to pay for pension benefits without decimating jobs and social services.”

Lee’s measure also didn’t win over Public Defender Jeff Adachi, who claims the proposal won’t make deep enough or fast enough cost savings in the next few years, so he will continue gathering signatures to place a rival measure on the ballot.

So rather than the consensus product Lee hoped the whole city family would be able to convince voters to support, it’s looking like pension reform could again be a divisive issue and one that spills over into this year’s mayor’s race.

Chiu thanked “our brothers and sisters from the labor community” when Lee announced his pension measure, noting that “each city worker that makes more than $50,000 would have to give thousands every year.” He supports the pension deal and hopes SEIU will eventually back it. Avalos and Sen. Leland Yee, another mayoral candidate, seem to be waiting for SEIU to sign on before offering their full support.

Mayoral spokesperson Christine Falvey told us that Lee views SEIU’s concerns as separate from the pension reform proposal. “He appreciates SEIU’s input in the pension reform talks and has committed to sitting down with them and trying to resolve this issue.”

Then there’s Adachi, who helped qualify Measure B, a 2010 pension reform proposal that united labor and city leaders in opposition. He continues to gather signatures to qualify a competing pension measure, needing about 50,000 signatures by early July unless Lee amends his plan to secure greater cost savings in less time.

“My focus is on this issue,” Adachi said, praising Lee’s efforts at achieving consensus. “But is this going to solve this problem so we don’t have to come back within two to three years? It comes down to a math problem.”

Adachi says Lee’s plan doesn’t adequately address the city’s need to save money now.

“The stress period is really in the next four years, so my hope is that the mayor’s proposal could be strengthened,” Adachi said, noting that his proposal yields $90 to $144 million in annual savings, compared to $60 to $90 million annually under Lee’s plan.

“SEIU is right that Mayor Lee’s proposal is inequitable,” Adachi added, noting that Measure B was criticized for being unfair to lower-income workers. “That’s why my new proposal increases pension contribution rates in $10,000 graduations. But under Lee’s plan, a person who earns $100,000 contributes the same rate as someone who makes $50,000.”

He criticized Lee’s plan for requesting only modest increases from safety workers. “Police and fire cost two to three times as much as everyone else’s retirement. They pay 17 percent of what’s in the fund and take out 36 percent. So that means SEIU folks are subsidizing the costs of safety workers’ retirement.”

Adachi acknowledged it would be better to have one measure everyone can support. “But I don’t agree that we should put ineffective reform on the ballot,” he said.

Adachi took a lead role on the issue in 2010 when he qualified Measure B mostly with backing from a few wealthy sponsors, including venture capitalist Michael Moritz, a financial supporter of Republican Ohio Gov. John Kasich and the Ohio Republican Party. Adachi took lots of political heat for the move, but he shrugs off the criticisms.

“It comes down to making sure people understand the issue,” he said. “A year ago, no one was acknowledging that it was a problem, but now everyone does. I’m hoping the board strengthens the proposal. It’s going to take supervisors really looking at this to see if works, not just jumping on the bandwagon.”

According to the Department of Human Resources, Lee’s plan would yield an estimated savings of $800 million to $1 billion over 10 years, with the bulk coming from increased employee retirement fund contributions of up to 6 percent for future and current employees. The proposal raises the retirement age from 62 to 65 for most city workers and from 55 to 58 for public safety workers. It also imposes caps on pensions for new employees.

Lee’s proposal must now make its way through the Rules Committee and win the approval of the full board by July 12, the deadline for supervisors to submit charter amendments. According to the Department of Human Resources, 89 percent of San Francisco’s 26,000 city workers earn more than $50,000. That means only 3,000 city workers fall below the $50,000 cut-off that exempt them from paying extra, under Lee’s plan.

But Larry Bradshaw, a bargaining unit member of SEIU 1021, said that members who make slightly more than that threshold will face pay cuts under the plan, on top of the pay cuts they took last year to avoid being laid off by Mayor Gavin Newsom.

For certified nursing assistants, the shift would amount to a roughly $12,000 annual pay cut, Bradshaw said. Security guards would face an estimated $5,000 per year cut, and clerical workers could face anywhere from $1,000 to $11,000 per year.

These workers faced getting fired and rehired at lower-paid classifications to make up for a revenue shortfall, but the union reached an agreement to stave off the worst pay cuts for those “de-skilled” employees by imposing a one percent across-the-board cut for all members in order to restore the salary cuts.

As SEIU workers take the pay cut to fund pensions, he said union members won’t be able to continue subsidizing the salaries of these deskilled workers.

“So we’re not going to have that option of asking our members to keep funding these workers who have taken this 20 percent pay cut,” he said. “And these are primarily women and people of color.”

But Sup. Sean Elsbernd and other supporters of the pension deal say the plight of these workers is an unrelated issue. “They aren’t a pension issue, so wouldn’t it be more appropriate to discuss them in the collective bargaining context?”

Elsbernd believes Lee’s measure is “fair and equitable,” partly because employees’ pension contributions would be reduced in boom years when tax revenue and stock market gains swell the city’s coffers.

“But Jeff Adachi is throwing a big roll of the legal dice,” Elsbernd said. He noted that city employees have long paid 7.5 percent toward their pensions. “But now, along come two pension reform plans that both challenge that notion.

“And every case in California shows you have to provide a commensurate benefit to change that kind of right,” he continued, arguing that Lee’s proposal is more legally sound because it lowers employees’ contributions during boom years. “So the $60 million that our plan would save is a hell of a lot more secure than the $90 million Jeff claims his plan would save.”

Sup. David Campos has yet to take a position on Lee’s plan, but hopes there is a way to address legitimate concerns about lower-income workers. “There’s no question that we have to do something about pension reform,” he said. “I don’t know if there’s a perfect proposal. But I’m especially intrigued by Mayor Lee’s plan. It recognizes that low-wage workers should not be expected to contribute at a higher rate than higher-wage workers. But we have to put the mayor’s proposal in the context of what else is happening, which is why SEIU’s de-skilling concerns are legitimate.” Campos credited Adachi for highlighting pension reform. “My hope is that we can come up with something that we can all be supportive of, where the mayor and Jeff’s proposals are combined. And while we have to be careful that the balance that has been constructed is maintained, this allows for a dialogue at the board, and for Jeff to be involved, so we can come up with a unified proposal. Because if we are going to address pension reform, we need to do so with a united front.”

FBI spying will be an issue for new Police Commissioner

When Police Chief Greg Suhr got sworn in at City Hall a month ago, reporters each got to ask one question during a hastily convened media roundtable inside Mayor Ed Lee’s office. And since the Guardian’s story about the FBI’s secret agreement with the San Francisco Police Department had just hit the streets, I asked the new Chief, if he would welcome clarification around the duties of SFPD officers assigned to the FBI’s Joint Terrorism Taskforce.

Chief Suhr said he believed an examination of the wording of the FBI’s most recent memorandum of understanding (MOU) with the department was already under way. “I believe that the MOU is being revisited,” Suhr said. “I have not been a part of that, but again I think we have a real good policy with regard to our intelligence gathering and that does supercede any ask of any other agency. The officers are bound by policies and procedures. And that policy was well thought out with tremendous community and group input years and years ago, from situations that have not since repeated themselves. I think a lot of people back then couldn’t believe they happened in the first place, but I think measures were well thought out and put in place to make sure we don’t have a problem again.”

Fast forward three weeks, and Suhr found himself in the hot seat at a May 18 joint meeting of the Human Rights Commission and the Police Commission, where commissioners got an update about the Police Department’s response to community concerns about surveillance, racial and religious profiling of Arab, Middle Eastern, Muslim, and South Asian Communities and the potential reactivation of SFPD Intelligence Gathering.

After Suhr introduced his new Command Staff—and stressed their great diversity–Police Commission President Thomas Mazzucco, who was Suhr’s football coach in high school, tried to assure folks that the Police Commission, the Human Rights Commission, the FBI, the SFPD, the American Civil Liberties Union and the Asian Law Caucus had already addressed the community’s intelligence-gathering concerns, in part through a bureau order that Chief Suhr then introduced during the hearing, in which Suhr clarified that SFPD policies trump FBI guidelines every time.

And Mazzucco,  a former Assistant U.S. Attorney for the Northern District of California and a former Assistant District Attorney for San Francisco, before Mayor Gavin Newsom appointed him to the Commission in 2008, noted that the community’s concerns were based on allegations. not factual findings.

But his comments got folks wondering whether Mazzucco’s prior involvement with the feds left him with a blind spot that is preventing the Police Commission from dealing with the issue in a timely and effective manner, particularly since Commissioner Jim Hammer’s term has expired, and the rest of the Commission is waiting for the Board’s Rules Committee to decide between nominating David Waggoner, L. Julius Turman, Phillip Hogan or Vanessa Jackson as the next new Police Commissioner.

For, as members of the public observed during the meeting, if the Police Commission President himself expresses no outrage at finding that the Commission’s policies have been undercut for the past four years by secret agreements between SFPD and the FBI, how can San Francisco claim to have a credible system of civilian oversight?

Instead, they felt that Mazzucco seemed more concerned about defending federal practices and officials, who were unwilling to show up at the May 18 hearing, than worrying about the role and authority of the civilian oversight body he now represents. And attorneys with the ACLU and the Asian Law Caucus noted that though Suhr characterized his new order as being based on the Portland resolution and a prior proposal from community advocates, they believe Suhr’s approach can only work with the written consent of the FBI, (which SFPD doesn’t have) if the FBI’s 2007 contract is left in place.

“That’s why there is a need for a transition to a non-MOU, Portland-style resolution,” ACLU’s John Crew told the Guardian, noting that ACLU’s willingness to work collaboratively with the commissioners and the new Chief should not be confused with a willingness on ACLU’s part to roll over and accept an approach that is based on wishful thinking rather than the realities of the MOU that’s still in place.

During the May 18 joint hearing, Chief Suhr acknowledged “the validity of the perceptions raised by the community,” even as he insisted that SFPD has “very strict policies” in place to ensure appropriate oversight for investigation- involving activities.

Suhr summarized the history of those policies, including ACLU’s John Crew’s involvement in creating Department General Order (DGO) 8.10, which establishes that there must be reasonable suspicion before SFPD intelligence gathering can occur.

Suhr noted that SFPD joined FBI’s Joint Terrorism Taskforce (JTTF) after the September 11, 2001 attacks, and SFPD officers assigned to the JTTF subsequently came under control of the Department of Homeland Security unit, but starting now, they are back under SFPD’s special investigations.

“I gave the order today that JTTF will be moved back under SFPD’s special investigation unit,” Suhr said. “They will have the security clearance necessary to oversee the activities. The members are required to comply with all department policies, even if they can conflict with FBI policies. Simply said, San Francisco policies, procedures, laws, and statute trump any federal policy or procedure. Our officers are bound by those.”

Suhr said that to ensure everyone is clear about the chain of command, he’d drafted his May 18 bureau order. “It essentially turns back the clock and emphasizes that officers are responsible for our policies and procedures first, and our officers are bound to identify themselves as San Francisco police officers,” Suhr said, further noting that he’d be happy to further amend his new order as needed.

And Mazzucco noted that SFPD has absolutely no jurisdiction whatsoever over the Transportation Security Administration’s activities at the airport.

But while Human Rights Commission Chair Michael Sweet said Suhr’s new bureau order,  “goes a long way toward helping to alleviate some of the concerns,” he and many commissioners noted that this was their first chance to read the order. And Sweet said he saw the May 18 joint hearing “as by no means the end of the discussion.”

HRC director Theresa Sparks, who was on the Police Commission when the FBI drafted its 2007 JTTF MOU, noted that the issue is not whether we should opt out, but what we can do to ensure that officers involved in activities have “strong civilian oversight of their activities and report activities through the established civilian oversight mechanisms and procedures defined in DGO 8.10.”

” Our approach to achieve this objective is to publish internal directives ensuring our officers only participate in activities that meet our local standards of reasonable suspicion,” Sparks stated, claiming that Suhr’s order will “ give the city control over misconduct charges and allegations of misconduct charges.”

Sparks noted that the May 18 hearing was a status report about “alleged violations by the FBI and SFPD, as well as airport police,” and that the HRC “did no independent investigation” to verify these allegations.

Sparks added that HRC and the Immigrant Rights Commission has a tentative agreement to move forward with townhall meetings to address community concerns, and will encourage the Board to appoint a special prosecutor to determine if the prosecution of terrorism cases is valid and fair, and discuss the need for an Ombudsman at the airport. And she talked about the need for SFPD to establish legal safeguards, mechanisms for greater transparency and oversight, and conduct more detailed yearly audits.

“Tonight was a real dialogue about the issues,” Sparks said, further noting that civilian oversight of local JTTFs is also a popular discussion in Oakland and in Portland, Oregon, which has decided to rejoin its local JTTF after opting out in March 2005. But she didn’t mention that Portland had entered into a resolution with the FBI, instead of signing a new MOU with the feds.

That explanation was left to Veena Dubal of the Asian Law Caucus and ACLU’s Crew– in between explaining why they believe Suhr’s Bureau Order isn’t enough. “The good news is that we all collectively agree that SFPD policies should apply to SFPD officers assigned to the JTTF,” Dubal said. “The bad news is that the recently released MOU, which was secret for four years, doesn’t reflect our collective desires.”

Dubal stated that the FBI won’t amend its 2007 MOU with the SFPD.
“And that is why the Chief issued the bureau order,” Dubal stated, claiming that the FBI Special Agent in Charge of JTTF involvement recently told ALC and the ACLU that the FBI will continue to block key parts of local policy central to accountability and oversight.

“But there’s a solution and it doesn’t necessitate a divorce from the joint terrorism task force,” Dubal continued, noting that there are now two ways for local law enforcement officers to participate in JTTFs: an MOU, in which SFPD resources are put into the hands of FBI with relatively no local control, as in the SFPD’s 2007 agreement with the FBI. Or via a resolution which the federal government just approved in Portland, which allows participation in the JTTF, but provides much better protection for civil rights and gives the police department and the police commission more control of the relationship.

Dubal noted that in the decade since 9/11, the FBI has expanded its intelligence powers, and its agents are now allowed to conduct intelligence without a factual connection to criminal activity.

“Given these massive shifts in FBI activity, the question is, what should the relationship between the SFPD and the FBI look like?” Dubal said.

“Unlike the FBI, the SFPD is not a national security organization, “ Dubal continued, noting that when SFPD signed up to work with the JTTF under an MOU that preserved local control and policies, “it wasn’t assuming that some of its officers, paid for by San Francisco taxpayers, could be transformed into national security agents.”

”The SFPD signed on without telling anyone, not even the police commission,” Dubal said, noting that SFPD cannot afford to participate in these practices. “We need community trust to keep all of our communities safe.”

ACLU’s Crew noted that the FBI came to the SFPD in 2007 with a new MOU. “And perhaps inadvertently, there was no review by the City Attorney, and no notice to the police commission,” Crew said. “And it’s a drastically different MOU, unfortunately.”

“Now, we didn’t know about that MOU because it was kept secret at the insistence of the FBI for four years,” Crew continued, further noting that when ACLU and ALC met with the SFPD in 2010, they were suddenly told that the police department couldn’t talk about these issues without FBI permission.

“That set off a warning sign,” Crew observed, noting that in early April, when the ACLU and ALC finally got the MOU released, their worst suspicions were confirmed.

“There was no public discussion of transforming the SFPD into a national intelligence gathering association,” Dubal said. “The problem is that the FBI changed the deal, and the SFPD signed it, without telling anyone.”

Dubal noted stark differences between the FBI’s 2002 MOU and the one the SFPD signed in 2007, along with stark changes to FBI guidelines that occurred in 2008, in the dying days of the Bush administration, and that now allow a new assessment category, that does not require reasonable suspicion and has been criticized by civil liberties groups.

And according to Crew, the FBI’s new MOU “puts at risk the very concept of civilian control.” As Crew noted, between the mid 1990s, when the SFPD developed DGO 8.10, which governs its officers’ intelligence-gathering policies and procedures, and 2007, when the FBI prepared a new JTTF MOU, there’d been little controversy over intelligence-gathering in San Francisco.

 “And then, perhaps inadvertently, the SFPD signed that MOU and it was drastically different and kept secret at the insistence of the FBI for four years,” Crew observed.

And in 2010, the SFPD suddenly said it couldn’t talk about the issue without the permission of the FBI, Crew added, noting that “Unnecessary secrecy breeds suspicion.”

“We don’t think the Bureau Order is sufficient,” Crew concluded. “This is an issue that has to be dealt with at the Police Commission level.”

Crew noted that the Portland City Council chose not to enter into an MOU, “specifically because it restricts the ability to provide local control and local oversight. “

“So, we are not saying opt out, but we are saying there needs to be a transition to a resolution that maintains local control over the assignment of officers and provides all these elements of civilian oversight,” Crew continued.

He claimed that the federal government says a resolution is possible, as long as you’re not doing it under an MOU.
“So the question is, if that level of protection is available now to the people in Oregon, why would San Francisco not take the same deal?” Crew said. “All you have to do is give 60 days’ notice to the FBI that are you going to start this transition to a resolution. That notice period allows the FBI to have any comments or express any concerns they want, I think it’s very regrettable that they chose not to participate tonight and unfortunately I think it says something in terms of how seriously they take these concerns.”

Crew concluded that such a transition would be a win-win situation.

”If we went to a resolution that merely asserted local policy, then they could keep doing exactly what they’re doing now,” Crew said. “On the other hand, if it turns out that there’s activities SFPD is involved in that they shouldn’t be involved in, don’t we want those stopped?

“The one comment I will make of the bureau of general order is that I’m thankful to hear it’s a work in progress,” Crew added, noting that ACLU and ALC “don’t think a bureau order is sufficient. That’s because it can be changed at any time without the notice of the police commission, without a public hearing.”

But Mazzucco disagrees with ACLU and ALC’s claims that FBI intelligence-gathering guidelines have been relaxed since 2008.
 “There are no random assessments, and there has to be a predicate of a criminal violation,” Mazzucco told commissioners, noting that ” with honorable people like Bob Mueller” (Mazzucco’s former boss) “running the FBI, there should be a level of confidence that there will not be any violations.

And in a follow-up call, Mazzucco told the Guardian that he thought Suhr’s bureau order clarifies that “local officers follow SFPD rules.”

Mazzucco also suggested that Police Commission oversight, “is more over policy and procedures and less about operations,” by way of explaining how the SFPD’s 2007 MOU  with the FBI never came before the Commission.
“But I suggested that we see the next MOU in this area,” Mazzucco added.

And he proposed “a simple solution” moving forward, namely transparency and educating the public,” about the JTTF.

“SFPD is probably the most diverse police department in the country,” Mazzucco said. “And there is civilian oversight. We won’t let anything untoward happen.”

And he praised the new US Attorney for Northern California Melinda Haag, and FBI Special Agent Stephanie Douglas for their participation in recent meetings with city officials about the community’s intelligence-gathering concerns.
“The good news is that nothing controversial is going on here,” he said, noting that out of the broad array of community advocates who showed up at the May 18 joint hearing, there were maybe five citizens who spoke about encounters with the FBI, and only one from the Bay Area. ”My goal is to make everyone feel comfortable,” he said.
 
But HRC Chair Sweet acknowledged at the May 18 joint hearing that it was “very difficult” to know from a first reading of Suhr’s Bureau Order if it fully addressed the community’s intelligence-gathering concerns. “I think a great deal of discussion really needs to take place on that particular issue,” he said.

And HRC Vice Chair Douglas Chan dug into the details, starting with the apparently now classified question of how many SFPD officers are currently assigned as deputized FBI officers.
”We don’t generally discuss the specific numbers, but I will tell that you we’ve never had less than two officers assigned to the JTTF,” Suhr replied.

And he told Chan more work can be done on the Bureau Order. 
“The intent of the order was to align it with DGO 8.10 and to close any gap that was in the 2007 MOU,” Suhr said.

Chan asked if SFPD has in mind “ a framework or an approach” if a case arises, wherein an officer, in order to defend himself against an allegation of misconduct, or a citizen seeking to discover facts and other evidence relating to an incident, bumps up against this need to know and the fact that apparently JTTF activities are, “under a federal classified information.”

“I think that would probably need to be flushed out in subsequent drafts of the bureau order,” Suhr replied. “I think we could turn the clock back to where the officers are ultimately accountable to the police department, the commission and the citizens of San Francisco.  I think that the most recent MOU, as has been discussed, there was somehow a mishap where it was not reviewed.”

 And while Police Commissioner Petra DeJesus said Suhr’s Bureau Order was, “a step in the right direction,” she added that she felt it needs to be amended to clarify how the Police Commission would truly have oversight of SFPD officers’ JTTF activities.
‘Even though a commissioner is going to look at what’s been done monthly, that commissioner doesn’t have the clearance, and we’d only see a sanitized version of the events,” she observed. “And we need to look at the auditing report part of it.”
 
 And Police Commissioner R. James Slaughter said he thought everyone was “frustrated that the FBI is not here to answer some of these questions.” I think that would help us.”

And now, with four candidates vying to replace Jim Marshall as the seventh Police Commissioner, it’s not clear what the Police Commission will do beyond Suhr’s Bureau Order. But clearly that question now becomes part of the commission selection process.

And so here is the basic direction of Suhr’s new Bureau Order:

 
Under Suhr’s new Bureau Order (not to be confused with an FBI order) SFPD officers assigned to the FBI’s terrorism task force must abide by local policies protecting civil rights rather than looser federal rules.

 “It is the responsibility of the Federal Bureau of Investigations (FBI) to prevent, investigate and respond to terrorism in the United States.” Suhr’s May 18 order states. “The FBI has established local Joint Terrorism Task Forces (JTTF) to share resources and coordinate among federal, state, tribal and local governments. It is the policy of the [San Francisco Police] Department to help prevent and investigate acts of terrorism, protect civil rights and civil libertes under United States and California law, and promote San Francisco as an open and inclusive community by participating in the FBI Joint Terrorism Task Force.”

“The Chief may assign SFPD offices to work on JTTF investigations that comply with the requirements stated above regardless of whether or not the investigation is based in the City & County of San Francisco,” Suhr’s order, which was issued by Deputy Chief Kevin Cashman, continued.

 “SFPD offices shall work with the JTTF only on investigations of suspected terrorism that have a criminal nexus,” Suhr’s Bureau Order concludes. “In situations where the statutory law of California is more restrictive of law enforcement than comparable federal law, the investigative methods employed by SFPD officers working on JTTF investigations shall conform to the requirements of such California statutes. While cross-designated and deputized as federal officers for the purposes of their JTTF assignments, when not operating in a covert or undercover capacity, SFPD officers shall always identify themselves to members of the public as SFPD officers.”

Or as Suhr told commissioners May 18, “Our officers will follow our department orders.”

Bliss Dance grooves on Treasure Island

Dancing against the San Francisco skyline, perhaps looking even more vibrant and beautiful that she did at Burning Man last year, Bliss Dance – a 40-foot steel sculpture by Marco Cochrane and company of a nude woman feeling her musical bliss – was feted by city leaders and residents during a reception at its temporary new home on Treasure Island last night.

Mayor Ed Lee thanked the Black Rock Arts Foundation, a nonprofit offshoot of Burning Man that helps place art in San Francisco and other cities, for its work on this and other local projects. “You’re really helping us revitalize so many areas,” Lee said, adding, “I know there will be many more sculptures on this island.”

Lee pledged to extend the six-month temporary placement, telling the crowd of hundreds, “It will go beyond October out here,” And he even expressed an interest in visiting Black Rock City when he said, “Perhaps I will join you one day at Burning Man.”

Cochrane and his crew built Bliss Dance for Burning Man right there in a Treasure Island warehouse, where an increasing number of projects for the event have been built in recent years. His latest piece, Truth and Beauty, is now under construction on the island, as is artist Peter Hudson’s latest work, Charon, and many others.

After being introduced by Lee, Cochrane said he appreciated being raised in California by hippie parents who encouraged his “puppy-like optimism…And I was fortunate enough to be able to keep it.” They encouraged him to “follow your bliss to the fullest” and “to believe that you have an inherent nature and to believe that it’s good.”

Cochrane was drawn to express his artistic vision by conveying the mysterious beauty and fire of women because “their energy is difficult to quantify in this world.” It is also difficult to explain the impact this sculpture has on those who see it, particularly during an event like last night’s when it spectacular lighting effects were on full display, a vivid and inspiring image when set against our scenic city.

“Follow your bliss and it will open doors where you didn’t know doors existed,” Cochrane told the crowd before restarting the dance party with a musical performance by Deja Solis, the model for both Bliss Dance and Cochrane’s latest work, Truth and Beauty, in which the nude woman will be stretching her arms to the sky, 55-feet into the air.

SEIU 1021 withholds support for newly unveiled pension proposal

San Francisco’s largest labor union, Service Employees International Union 1021, is not on board with a proposed charter amendment that would reform the city’s pension system for public employees.

The pension reform proposal was unveiled by a coalition of city officials, labor representatives, and business leaders at a press conference in the mayor’s office in City Hall this morning, May 24. The plan would yield an estimated savings of $800 million to $1 billion in savings over the course of a decade, the bulk of it coming from increased employee contributions to retirement funds of up to six percent for future and current employees. The proposal would raise the retirement ages from 62 to 65, or 55 to 58 for public-safety workers, and impose caps on pensionable salaries for new employees. Mayor Ed Lee described the plan as “a serious, comprehensive plan and one that reflects the consensus.” The proposed charter amendment must go through the Board of Supervisors’ Rules Committee and win the approval of the full board before it can be placed on the ballot in November.

Lee emphasized that the pension plan had been crafted with a consensus-building approach over the course of several months, which brought business, labor, and city officials together. Billionaire Warren Hellman delivered comments about the historic nature of the proposal, and Rebecca Rhine from the Municipal Executives Association and Steve Falk from the San Francisco Chamber of Commerce each voiced support for the plan.  Sups. Sean Elsbernd and Board President David Chiu spoke of the collaborative and democratic process that had brought everyone in the city family under one tent.

Well, almost everyone.

“We’re stuck on one issue,” noted SEIU 1021 Vice President Larry Bradshaw. Under the plan, a pay cut would go into effect for three groups of lower-paid workers on the same date that they would be responsible for making new pension contributions, July 1, 2012, he explained. The affected workers include nursing assistants, security guards, and clerical workers, he said. While the mayor’s proposal requiring new pension contributions builds in an exemption for city workers making less than $50,000 per year, many of these SEIU employees would fall just above that cutoff mark, Bradshaw said.

“We’ve got workers that are just about at the $50,000 threshold … so they’re going to be paying about $2,000 a year out of their pocket,” toward new pension contributions, he said. “So the mayor’s plan has these workers, who are our lowest-paid workers, taking this huge pay cut, and then they want us to agree to this increase in contributions. And the scale of these pay cuts are just enormous. For someone who’s making $50,000 a year, to ask them to take $2,000 or $3,000 on top of $12,000 in a pay cut, is impossible.”

The pay cut is a leftover from the administration of former Mayor Gavin Newsom. For certified nursing assistants, the shift would amount to a roughly $12,000 annual pay cut, Bradshaw said. Security guards would face an estimated $5,000 per year cut, and clerical workers could face anywhere from $1,000 to $11,000 per year. Bradshaw estimated that a total of about 570 city employees would be affected. The workers faced getting fired and re-hired at lower-paid classifications in a prior budget year to make up for a revenue shortfall, but the union reached an agreement to stave off the worst pay cuts for those “de-skilled” employees by imposing a one percent across-the-board cut for all members in order to restore the salary cuts.

“This was such a sore point with our membership, the membership would not allow us to turn our backs on these workers, and we couldn’t get the city to restore the pay cuts,” Bradshaw said. “So we voluntarily took a one percent pay cut for every member to make up the loss in pay that these workers suffered.”

This arrangement would no longer be possible under the pension reform proposal, he said, because most union members would be asked to contribute 3.5 to 5 percent toward their pensions. “We’re already paying one percent more, so we’re not going to have that option of asking our members to keep funding these workers who have taken this 20 percent pay cut,” he said. “So the same day this goes into effect, these people take this horrible hit in their pay. And these are primarily women and people of color. Our problem is, we can’t leave these workers behind.”

Until that issue is resolved, the union cannot get on board with the plan, he said. “We’ve been waiting three weeks to meet with the mayor, and we can’t fix the problem if we can’t sit down with the mayor and talk about it,” he said, noting that  union representatives had been able to sit down with mayoral chief of staff Steve Kawa. Restoring the pay cut would have an estimated financial impact of $5 to $6 million.

Bradshaw said SEIU 1021 had hoped to fix the problem in order to be able to get on board and voice their support during the announcement this morning. “We were at the table until 11:30 last night,” he said. “We called the mayor, we had Tim Paulson at the [San Francisco Labor Council] text the mayor, we asked the city team to ask the mayor to come in. The mayor was a no show.” The Guardian has placed calls to the mayor’s office seeking comment, but hasn’t yet heard back.

Asked what he thought the outcome might be, Bradshaw said, “We think this situation cries out for justice. We think there are lots of ways to solve this problem, and we keep putting ideas on the table that are rejected by the mayor’s office. We’re hopeful. But, until we sit down with the mayor, it’s kind of a big question mark.”

SEIU 1021 represents around 17,000 city workers, making it the largest and one of the most politically powerful labor unions in the city.

Pattie Tamura attended the press conference on behalf of SEIU 1021, but stopped short of voicing support for the proposal when reporters questioned whether the union was on board with the plan, saying only that negotiations were ongoing. Bradshaw said they sent a representative as a sign of respect for the collaborative process that had been spearheaded by coalition leaders, particularly Warren Hellman.

Lee promised he wouldn’t run in November, and for some supervisors (particularly Sean Elsbernd, who nominated Lee) that was a deal breaker: Elsbernd told us he wouldn’t vote for anyone who wanted to seek a full term. But immediately some of Lee’s supporters began pushing him — quietly and not-so-quietly — to go back on his word and announce his candidacy.

Last week, a fake “draft Ed Lee” campaign emerged and got front-page treatment in the San Francisco Chronicle, despite the fact that it was orchestrated entirely by two political consultants. And word around City Hall is that Lee faces immense pressure to get in the race — and hasn’t entirely ruled it out.

That’s a problem. Lee is heading into a crucial budget season and will be negotiating with, and making deals with, a wide range of constituency groups. Everyone in town needs to know, now, what sort of mayor is running the show — a caretaker trying to get San Francisco through a rough time until a duly elected replacement can take office, or an ambitious politician looking at how to leverage this appointment into a four-year gig.

Lee has every right to run for mayor, and the filing deadline isn’t until August. By law, and political tradition, he can wait until the last minute to tell the city how he plans to spend the fall. And the fact that he promised not to run shouldn’t be an absolute bar: we never endorsed the idea of a caretaker mayor in the first place. What if Lee does a great job? What if the voters overwhelmingly want him to stick around? Why should that be off the table?

Still, this waiting game and this ongoing round of rumors and back-room discussions isn’t good for the city. If Lee wants to run, he needs to announce it now. If he’s not going to run, he needs to tell everyone — starting with Brown, Pak, and his other top backers — that he’s simply not going to do it, that he’s not changing his mind, and that they have to stop pushing him and making noise about it.

There are other candidates in the race, some directly involved in making city policy. When Sup. David Chiu talks about his budget priorities, we know exactly whom we’re dealing with — a board president who wants to be mayor. When City Attorney Dennis Herrera takes on the tricky job of running for mayor while serving as an impartial city legal officer, we know what the conflicts are. It’s not fair to them, or to anyone else, to be dealing with a mayor who may have secretly promised his supporters (who are also players and lobbyists at City Hall) that he’s getting into the race.

Lee may be personally undecided — but he can’t manage the city this way. He has to give San Franciscans a straight, and final, answer: is he running or not? Otherwise all these behind-the-scenes whispers, involving some very shady political operators, will fatally undermine his credibility.

Mayor Lee’s dismal budget challenge

The “create your own budget” app is nothing new; we’ve seen it at the state level for a couple of years. But it’s new to San Francisco, and Ed Lee’s promoting it. So you can go here and see if you can solve SF’s budget problems.


I did the whole thing, gave the best answers I could — and wound up with the city still deep in the red. That’s because the choices on the app are pretty limited. Only a few modest tax increases are available, along with a lot of cuts. There is, for example, no option for a commercial real estate tax, no option for a tax on vacant housing, no option for a prgoressive gross receipts tax, no option for a city income tax … just a higher sales tax, a utility user tax, and an increase in the (flat) payroll tax. Those are all somewhat regressive options (although the utility user tax isn’t that bad, but it offers a maximum of $4.6 million). All told, the taxes offered together make up about $60 million, or about 20 percent of the deficit.


So why the limited choices? According to the program, these options are “actual policy decisions the mayor and the board of supervisors must make in developing a balanced budget for the next fiscal year.”


Yes, but raising more revenue is also an “actual policy decision.” And while these budget simulators are just gimmicks, this one gives some indication of what Lee’s office things may be in the offing. And if these are the only options the mayor considers on the table, it’s not going to be a pleasant year for health, human services, parks, police, fire or anyone else.


  

Chronicle pushes fake campaign to “draft” Ed Lee

Downtown is clearly nervous about not having a reliable horse in the mayor’s race, so much so that a few power brokers are using the Chronicle to drum up a fake “campaign” to convince Mayor Ed Lee to break his word and run to keep the job. And the fact that these liars – those who just six months ago earnestly argued we need a caretaker mayor who won’t run for the office – are pushing this with a front-page, above-the-fold “news” story shows just how shameless they are.

Say what you will about this year’s field of mayoral candidates, but they do represent a broad range of constituencies and they include several seasoned politicians who are well-qualified to be mayor. Sen. Leland Yee has served in a variety of public offices for decades, Sup. John Avalos is a reliable progressive intimately familiar with the workings of City Hall, Dennis Herrera and Phil Ting each hold citywide offices to which the Mayor’s Office is the logical next step, Michela Alioto-Pier is a consistent supporter of ruling class interests, and David Chiu has proven his political skills by engineering his reelection as board president and installing Lee as mayor.

So why exactly do people want to convince Lee to go back on his word, as well as giving up the city administrator position that the board just cleared the way for him to return to with an ethics exemption? Well, the Chronicle article doesn’t really make that clear, all it makes clear is that’s what Willie Brown and Rose Pak – as well as their errand boys, former Sup. Michael Yaki and downtown consultant Jim Ross – want.

And why do they want Lee to remain in the Mayor’s Office? Because they’re the ones who put him there and he has done nothing to challenge the corrupt status quo at City Hall, where corporate desires trump people’s needs every time. Chief-of-staff Steve Kawa is still calling the shots, Brown’s clients and developer buddies are still getting what they want, and Pak still gets to be the de facto leader of Chinese-American interests in City Hall.

They desperately fear that Yee will win the mayor’s race and clean house, kicking out Kawa and all of the Brown and Pak cronies, greatly reducing their power in San Francisco. And the rest of the candidates are too independent and broad-based to guarantee the continued power of Brown and Pak and the downtown interests they represent. Their only hope is that they can cut some kind of deal with Chiu to maintain their influence in the next administration by applying pressure through this article and the others likely to follow in this fake draft-Lee campaign.

To his credit, Sup. Sean Elsbernd isn’t taking part in this shameless charade, instead sticking by the statements he made when he nominated Lee to be mayor, telling the Chronicle that in a year with tough political decisions on the budget, pension reform, and other pressing issues, “this city desperately needed someone who wasn’t going to play election-year politics,” and that, “if he files papers to run for mayor, all that goes away.”

That’s true, along with any illusions that Lee and those who back him have any integrity.

City officials pedal and praise on Bike to Work Day

Almost every top city official pedaled up to City Hall this morning for the 17th annual Bike to Work Day, all pledging their support for expanding safe cycling opportunities in San Francisco and declaring the bike to be a vital part of the city’s transportation infrastructure that will only grow in importance in the coming years.

“We should all feel proud that we have more to celebrate than ever in the history of Bike to Work Day,” said Leah Shahum, executive director of the San Francisco Bicycle Coalition, which sponsored the event and facilitated the rides by city officials, including riding Sups. Jane Kim and Carmen Chu to work on tandem bikes. Shahum praised the city for rapidly expanding the network of bike lanes and facilities over the last year.

Shahum accompanied Mayor Ed Lee on a ride along JFK Drive in Golden Gate Park (which Lee announced will soon get the city’s next separated green bikeway), along car-clogged Fell and Oak streets, through the Wiggle, and along Market Street toward City Hall.

Lee told us, “I feel good, exhilarated,” as he neared City Hall, where he and officials gave speeches praising bikes and calling for improvements to the system. “I want to experiment with ways to have detached bike lanes on Fell and Oak,” Lee said to the applause of cyclists familiar with competing with cars on those fast-moving streets.

Lee also declared his support for the goals of SFBC’s Connecting the City initiative, which calls for a system of safe, crosstown bikeways, connecting the bay to the ocean and the northern waterfront to the south side of the city. He also called for continuing the green bike lanes on Market Street all the way to the Ferry Building and said, “I’m dedicated to it.”

Board President David Chiu, who sponsored the legislation that set the goal of achieving 20 percent of all vehicle trips by bicycle by the year 2020, said he was proud to see so many bikes on the streets today. “Thank you for showing the world how we roll,” he told the crowd, also voicing his support for the crosstown bike route plan. “We have to imagine safe enough conditions for 8- and 80-year-olds to bike.”

“It makes us a healthier, happier, and more vibrant city when we bike together,” Sup. Eric Mar told the gathering.

Sup. Sean Elsbernd was the only member of the board not to bike today, but his fellow fiscal conservative Sup. Mark Farrell biked in from District 2 and told the gathering that improving the city’s bicycling infrastructure “is critical to our future.”

Chu doesn’t ride a bike, but she hoped on a tandem bike with SFBC board member Amandeep Jawa and told him, “Thanks for helping me see San Francisco in a new way,” noting her new appreciation for the sights, smells, and small details that opened up along a route to work that she usually drives.

Sup. Ross Mirkarimi called his District 5 the “epicenter” for cycling in the city and declared, “It’s time that we take back Masonic Boulevard…to make sure it’s safe for bicyclists and pedestrians.”

Sup. Jane Kim told the crowd, “I grew up a city girl and I never learned how to ride a bike,” but said that former SFBC director Dave Snyder and others have been trying to teach her recently. In her ride in on the back of a tandem bike, “I got to feel how unsafe it is to have cars and buses jostle around you.”

Sup. Scott Wiener told the gathering, “This was my first Bike to Work Day and it’s not going to be my last.”

Sup. David Campos told us he really enjoyed his ride up Valencia Street, where the stoplights are timed to the pace of bicyclists. “It’s the best ride in the city. If we can make more streets like Valencia we’d be in better shape,” Campos told us.

In his speech, Campos said, “We have so much happening around bicycling, bu we also have a long way to go.”

Sup. Malia Cohen said she biked the longest way in to City Hall, all the way from 3rd Street and Thomas, and that she was happy about both the bike infrastructure improvements and carfree events like Sunday Streets. “I want to encourage you all to come out to the Bayview for Sunday Streets [on June 12],” she said.

For all the celebration and improvements to the system, Sup. John Avalos said it’s important to continue establishing respect on the roads for bicyclists. “We have to change many minds about biking in San Francisco,” he said.

To illustrate the increasingly important role that bicycling is playing in San Francisco, SFMTA Commissioner Cheryl Brinkman cited city studies showing a 58 percent increasing in the number of cyclists on the streets of San Francisco over the last four years, noting a comparable increase in Muni ridership or in motorists on the roads would have resulted in gridlock in those systems.

“It’s a good lesson for us,” Brinkman said, voicing support for the goal to creating 100 miles of dedicated bikeways throughout the city in order to promote safe cycling.

Campos urges Lee to implement entire due process law

After the Guardian broke the news that Mayor Ed Lee was planning to only partially implement Sup. David Campos’ due process legislation, we headed to City Hall to witness Lee announce his partial shift during question time. And afterwards, Lee told reporters that he spent the months since he was appointed reviewing the policy and talking with leaders in the city’s juvenile justice departments.


“I looked at the difference between youth with family here and youth who did not,” Lee said, noting that his decision to let youth that have family here to have their day in court is in keeping with his policy of focusing on family reunification and getting families more involved.


Lee stressed that youth with family here will still need to be enrolled in school and not be repeat offenders in order to have their day in court.


“It will be decided upon on a case by case basis,” he said.


Lee said he has had conversations with the federal government and US Immigration and Customs Enforcement (ICE) about the policy shift. “We have discussed this,” Lee said. “And we did get a very strong feeling that the federal government is a bit confused.”


Asked how far he is willing to go to defend this latest policy shift, Lee said, “I’ll take that up as it comes. President Obama is struggling with immigration right now.”


Reminded that his predecessor Mayor Gavin Newsom refused to implement any aspect of Campos’ due process legislation, even though a super-majority of the Board passed the ordinance in 2009, Lee said, “I don’t compare myself with the former mayor.”


Asked what percentage of immigrant youth that end up getting booked are “unaccompanied,” Lee said he did not have those statistics. “Check with Siffermann,” he said, referring to the head of the city’s Juvenile Probation Department.”


Lee’s announcement was met with mixed reviews among immigrant advocates.


Civil rights groups applauded Lee’s decision to immediately begin implementation of Campos’ legislation, which was passed in November 2009, restores due process for immigrant youth in the city’s juvenile justice system and ensures that innocent youth are not torn from their families for deportation.  But they also expressed disappointment that Lee will only be implementing the policy for youth who have immediate family here, and not for unaccompanied youth.  And they all urge him to fully implement what they described as Campos’ “duly-enacting, common-sense law so that all innocent youth receive protections.”


They noted that implementation of Campos’ broadly-supported law, which has been endorsed by over 70 organizations, had been stalled until today due to former Mayor Newsom’s refusal to enact the law. 


Under Newsom’s direction, Juvenile Probation reported over 160 youth to ICE at the point of arrest, prior to the youth receiving due process, based only on a juvenile probation officer’s “reasonable suspicion” that a youth is undocumented. 


Civil rights advocates note that Newsom’s problematic policy was responsible for tearing innocent youth from their families and spreading fear among immigrant residents around coming forward to cooperate with police, either as witnesses or victims of crime.  


And they observe that the policy that Juvenile Probation Department has been enforcing since the summer of 2008, and which involved reporting youth for life-altering deportation at arrest, went well above and beyond any obligations under federal law. 


They noted that, as a cadre of legal scholars, including University of San Francisco Law Professor Bill Ong Hing, have repeatedly made clear, there is no requirement imposed on city officials under federal law to ask about immigration status or to report individuals suspected of being undocumented.”


Ana Perez, executive director of Central American Resource Center, agreed.“While we appreciate Mayor Lee taking action to finally begin implementation, we are concerned that he is only implementing the policy for accompanied youth and not for youth who may be unaccompanied because they are trafficked to this country, are orphans, or are escaping persecution.”


“I’m certain it’s not for all youth,” Pérez continued. “So, it’s a small win. But what about the kids who are victims of human trafficking? The fact is we spent so much time developing a policy that was approved by a majority of the Board. So, this is bitter sweet.”


Asked what became of the criminal grand jury investigation that then US Attorney Joe Russoniello initiated in 2008, when Mayor Gavin Newsom was running for governor, and news first broke that the city was accompanying youth who weren’t here with family back to their home country, Pérez suppressed a snort. “It seems that was a bunch of empty threats to try and get the city to move to a more conservative position,” she said. “It’s been a whole new day with Obama.”


Angela Chan, staff attorney at the Asian Law Caucus said that Juvenile Probation’s prior policy of reporting innocent youth exacerbated the impact of a broken federal immigration system on local immigrant families. “We appreciate that Mayor Lee has taken this long awaited step forward because he values family unity and due process for youth,” Chan said. “However, we ask that the Mayor not exclude unaccompanied youth from receiving due process protections.”


Patricia Lee, managing attorney in the Juvenile Unit at the Public Defender’s Office also supported the demand for complete implementation of Campos’ legislation. “If you want the immigrant community to feel safe enough to cooperate with police and probation, then those agencies should not be viewed as representatives of immigration,” she said. “My clients and their families are scared of probation, they are scared of police. Selective implementation of the due process policy for only accompanied youth and not to unaccompanied youth does not solve this problem.” 


And Charles Washington, the Muni bus driver and longtime San Francisco resident, whose wife and 14 year old son were almost separated from him as a result of the prior Juvenile Probation policy, expressed concern that the policy would only be implemented for some youth. “I’m glad to see Mayor Lee is doing the right thing by implementing the due process policy,” he said. “However, he should not leave any youth, especially those who are most vulnerable, behind.”


Sup. Campos applauded the Mayor for implementing the policy while expressing disappointment that it is only partial implementation. As Campos’ stated during the Board meeting, but after Lee had already left, “This body enacted that law and that law needs to be respected.  It is not up to the executive branch to second guess the legislative branch.” 


Sup. Eric Mar added that he supports full implementation for all youth.


 And Sup. Jane Kim, who asked the Mayor during the Board’s Question Time about his plans for implementation, stated, “My hope is that he will commit to full implementation of this policy.”


But in the end, the burden fell on Campos to explain why partial due process is unjust. “This is a good first step, but it doesn’t go far enough,” Campos explained. “As I understand it, the decision Mayor Lee has taken is, that if you are a minor, and are accused of a felony, you will be given due process if you have family here. But if you are charged with a felony, but don’t have family here, then you will not be given due process. Let me begin by thanking Mayor Lee for at least taking one step in the right direction. That said, we still will not have full compliance with a law that was duly enacted by this body. Full compliance means giving every child that interacts with the juvenile justice system due process. So, {Mayor Lee’s first step] is simply not sufficient.”


Campos noted that when mayors are sworn in, they agree to uphold laws that the Board enacts. “So, the law needs to be respected,” Campos said. “It’s not up to the executive branch to second guess the legislative body. That second guessing can only be done by the courts. Therefore, we, once again, ask the mayor of San Francisco to comply with full implementation.”


Noting that a bedrock of the U.S.’ justice system is the principle that we are innocent until proven guilty, Campos said that if the mayor does not fully implement the law, as approved by the Board, “There’s a very real possibility that children that we are reporting [to ICE for possible deportation] are not guilty of what they have been accused of. So, once again, I ask the mayor to reconsider his opinion.”


Campos also noted that there are already procedures in place, within the existing juvenile justice system, to ensure that “we do not have individuals released who should not be.”


After the meeting, Campos noted that the format for the Board’s question time with the mayor currently leaves something to be desired: an opportunity for the Board to reply.


“It would be better if it would allow for some exchange, though obviously, we don’t want it to be a ‘gotcha’ game. But at this moment, it’s too rigid.”


 Asked who drafted the current Question Time format, Campos replied, “Board President David Chiu.”

Mayor Lee to partially implement Campos’ due process ordinance

Today at question time, Sup. Jane Kim will ask Mayor Ed Lee what his plan is to implement a due process ordinance that Sup. David Campos authored and a super majority of the Board approved in 2009, prohibiting the Juvenile Probation Department from reporting undocumented youths at the time of arrest. And according to an anonymous source, Lee will say he has decided to implement the policy, if the youth in question are “accompanied,” which means they have family here.

Immigrant advocates say Mayor Lee should be commended for his leadership in implementing the due process policy to keep immigrant families together. But they believe that Lee needs to go the whole way. “Immigrant and civil rights groups are adamant that the policy must be implemented for all youth, accompanied and unaccompanied, and this has to be immediately,” our source said. “The due process policy does not discriminate between these two groups and the policy cannot be selectively enforced.”
 
As Kim planned to point out during the Board’s question time, voters approved San Francisco’s Sanctuary City Ordinance in 1989. That ordinance prohibits our Police Department and local government officials from assisting in the prosecution of immigration enforcement unless it is required under federal or state law.

In 2009, the Board, under Campos’ leadership, passed-by a supermajority-a clarification to that ordinance to prohibit local law enforcement from reporting undocumented youths unless they are convicted of a felony. To date, this ordinance has not been followed by the City.

But in a May 9 memo to the city’s Probation Department personnel, Juvenile Probation Department Chief Probation Officer William Siffermann and Assistant Chief Probation Officer Allen Nance wrote that since revising JPD’s policy 8.12 nearly three years ago [per Mayor Gavin Newsom’s instructions], they have closely monitored JPD’s implementation of its protocols.

And after considering all perspectives and after careful review, they have decided to “modify our existing policy in a manner that aligns our Departmental policies more closely with the values inherent within San Francisco’s Sanctuary City ordinance, without compromising our balanced commitment to public safety and the best interests of the minor.”

“Effective immediately, San Francisco Juvenile Probation Department notices to the federal authorities of minor/persons booked on felonies who are suspected of being undocumented AND are accompanied (lives with a verifiable parent, guardian or blood relative in the immediate Bay Area and is enrolled in school) will be made only upon a felony adjudication, upon apprehension on an outstanding warrant, or upon issuance of a new warrant following release from custody pending adjudication,” the JPD memo reads. “Minor/persons booked on felonies who are suspected as being undocumented, AND are verified adults or unaccompanied by any verifiable parent, guardian or blood relative residing in the Bay Area, whether or not enrolled in school, will continue to be reported to the federal authorities upon determination of this status.”

“Policy 8.12 will continue to ensure that all suspected undocumented minors booked and convicted of committing a felony will continue to be reported to the federal authorities,” the JPD memo continues. ‘While the Department will neither assist nor interfere with the federal authorities’ overwhelming duties and responsibilities related to the enforcement of immigration laws, we will continue to honor their lawful detainers regarding suspected illegal immigrants.”

“We are confident that your uniform compliance with this policy adjustment will continue to reflect the Department’s interest and your professional commitment to preserving families while we discharge all of our many duties that protect public safety,” the JPD memo concludes.

At least, this Craigslist ad suggests you can. It doesn’t sound like Mayor Ed Lee wrote it himself:


For the past several years the Department of Recreation and Parks has been recognized as leader in the development of innovative programs to prevent the public from enjoying either recreation or parks. However, in a time of increasing budget shortfalls and political uncertainty, new directions must be found to preserve our civic treasures from our civic body.

Several recent initiatives, including privatization of parks, closing recreation centers, and placing advertising on every available public surface, have failed to keep people from going outdoors for free. We need bold ideas.

The qualified candidate will:

· Own a stun gun
· Possess strong ties to the business community
· Exhibit rudimentary math skills


And I can’t imagine who would have posted an ad like that. Certainly not some guy who threatened to barf in Dolores Park.


 

And the next chief is…yes, Suhr!

Mayor Ed Lee appointed a deeply emotional Captain Greg Suhr as Chief of the San Francisco Police Department during a swearing-in ceremony where the majority of folks were either elected officials, running for election, running each other’s electoral campaigns—or wearing SFPD uniforms.

And in the end it seemed that the choice may have been influenced by pressure from the powerful San Francisco Police Officers Association, judging from the comment Lee jokingly directed at SFPOA leader Gary Delagnes, saying, “Gary, it’s time to get quiet and go to work.”

Lee told a standing-room only crowd that when he returned from Hong Kong to San Francisco four months ago finding a new police chief was his top priority. And that initially it was suggested (Lee did not say by whom) that he leave the SFPD situation alone and allow an elected mayor to appoint the next Chief.

‘While I am an interim mayor, this is not an interim decision,” Lee told the crowd, signaling that while he may be out of office in January, Suhr may be here to stay as the city’s top cop.

“Today, I’ve chosen the best candidate,” Lee continued, thanking Acting Chief Jeff Godown for his work leading the SFPD since former Mayor Gavin Newsom made the shocking decision to appoint former Chief George Gascón as District Attorney.

But while Newsom’s move may have upset the apple cart in the D.A.’s race, it sure seems to be working out well for Suhr.

Describing Suhr as “a police and people’s Chief: and “a reformer from the inside out,” Lee ran through a long list of the new Chief’s contributions to the SFPD. These included Suhr’s 30 years of service, his climb through the ranks to become Captain of the Mission station, his gig as Captain of the San Francisco Public Utilities Commission in a Homeland Security capacity, and, since 2009, as Captain of the Bayview station.

Suhr began by saying he was “speechless.” Donning glasses to read a speech that he had prepared the night before, Suhr choked up when he talked of being “fourth-generation, born and raised in San Francisco.” Recovering his composure, Suhr smoothly changed gears, as he joked how his appointment therefore makes him “a local hire,”—an insider reference to Sup. John Avalos’ recently approved local hire legislation that Mayor Lee is helping enact citywide.

Suhr recalled how he started out as a rookie on the midnight shift in the Tenderloin in 1981. He thanked his family, his friends and his girlfriend Wendy. And then he asked for a moment of silence “ to honor the memory of all the brave officers who have given their lives in the line of duty.”

Lee reclaimed the podium long enough to jokingly ask Suhr  “to investigate the whereabouts of my birth certificate” as his first assignment as the new chief.

Then it was Board President David Chiu’s turn. Chiu described Suhr as someone, ”who knows our streets, walked the walk, and knows the beats, someone who we all feel confident will be able to bring the SFPD the reform that former Chief Godown, Chief Gascón and Chief Heather Fong initiated. “

San Francisco Superior Court Judge Katherine Feinstein, who is the daughter of Sen. Dianne Feinstein and the presiding judge of the Superior Court, recalled how she has known Suhr since the mid 1980s. “I have watched him as each of our careers have moved forward,” Feinstein said, noting how there were some “steps forward and some steps backward” and how, “there were those who thought this day would never come.” (Feinstein’s words were the only reference to some of the less sunny moments in Suhr’s long and distinguished career. These included his 2003 indictment as part of Fajitagate, an incident that involved off-duty officers, a bag of take-out food, a beer bottle and injuries sustained by two local residents. Suhr was cleared of wrongdoing the next year, but was reassigned by then Chief Heather Fong to the PUC position after an incident in 2005, in which a police officer was seriously injured at an anarchist protest, and videographer Josh Wolf was held in federal prison for 226 days after he refused to release unedited footage of the protest.)

Next up was D.A Gascón and his rooster-like shock of silver hair. Gascón noted that when he first came to San Francisco, in the summer of 2009, he had no allegiances to, and no prior knowledge of, people inside the SFPD.

“I looked at Greg Suhr and one of the things that impressed me is how he worked with and related to people,” Gascón said, explaining why he appointed Suhr as Bayview Captain “Not only has he exceeded all expectations he did an incredible job,” he said.

 Police Commission President Thomas Mazzucco said that in the 100 days since the Commission announced it was looking for a new chief, it became clear that Suhr has the support of SFPD’s rank-and-file.

Mazzuco noted that he met Suhr in high school. “I knew he could hold a ball,” Mazzuco added, noting that he subsequently became Suhr’s football coach, even though he is younger than Suhr. “What the Police Commission has brought to us is not only a native son but also a cop’s cop. It’s an honor to have him as his chief.”

And after the swearing-in, the sentiment among officers in blue appeared to be strongly in Suhr’s favor. Lt. Ken Lee of Central Station recalled how he and Suhr went through the police academy together about 30 years ago.

“We went to different assignments but we’ve maintained a friendship,” Lee said. “The moment I met him I liked him. He was a very stand-up person, and as a native San Franciscan like myself, you could tell he had strong ties to the city. He’s a hard worker, he’s very dedicated to what he does.”

Lt. Mario Delgadillo, also of Central Station, said Suhr hasn’t lost his connection to the street. “That also means a lot, when you have a boss who’s walking with you,” Delgadillo said.

Suhr takes over the SFPD as it’s grappling with the fallout from a recent spate of scandals, including videos that Public Defender Jeff Adachi released that appear to show police misconduct at residential hotels and that forced DA Gascón to hand over his investigation of this alleged police misconduct to the FBI. Asked during a media roundtable what his appointment means for Acting Chief Godown, Suhr said Godown has returned to being Assistant Chief of Operations, which was the post he held before Gascón, who recruited Godown from LAPD, was appointed DA.

In response to a question about his top priorities as police chief, Suhr noted, “When I sit down with the mayor this afternoon, the mayor’s going to tell me what his priorities are. My first priority will be blocking the door open on the 5th floor so that if you wanna come see me you can, like it used to be. Then I have to meet with the command staff and captains and get their take on where they think we are, where they think we’re moving forward best, and match that up against how I’ve seen from a position of Bayview, how that matches up. And then see if I can’t meet with different community groups, the different police employee groups and the command staff.”

He didn’t mince words when it came to indicating that SFPD officers are going to be asked to give back during upcoming budget negotiations
“I’m sure that there’s going to have to be adjustments and I look forward to working with a collaborative effort with the mayor and the board and the unions and the rank and file,” Suhr said. “When the economy’s been good we’ve benefited by it, and now that the economy has … gone the other way, to some extent I think that the officers are willing to give back to do whatever needs to be done to keep the city safe.”

So, how does Suhr think he differs from former Chief Gascón? 

”He has a gorgeous head of hair,” Suhr joked. “To put it in a sports analogy, he’s a quarterback shortstop guy, and I’m more of a catcher, lineman, linebacker kind of guy. But I admire him, I think he moved a lot of issues forward for the police department, and I look forward to continuing those initiatives and giving a few of them a shot in the arm that I think were beginning to wane a bit.”

Suhr also talked about how he has always wanted to become a police officer (a comment that suggests he’s not planning to use the Chief’s post as a stepping stone to the District Attorney’s Office).

”When I went into the police department. on Silver Avenue which is now Willie Brown Academy — that was the police academy back in 1991 when I came in — man, we looked at just the regular uniformed police officers with just stars in our eyes, because they were just the sharpest, classiest folks that we were aspiring to be,” Suhr said.

And he indicated that as Chief, he won’t tolerate dishonesty in the face of ongoing investigations into alleged police misconduct. ”The character of a police officer must be above reproach,” Suhr said. “And I think that the investigation will show what it ends up showing, but I don’t think that there’s a police officer in San Francisco that would want to have a dishonest cop and I’d be at the top of that list. So I want all my officers to be of character that is above reproach.

Asked if he welcome clarification around the duties of SFPD officers assigned to the FBI’s Joint Terrorism Taskforce, Suhr said he believed an examination of the wording of the FBI’s most recent memorandum of understanding (MOU) with the department was already under way.

“I believe that the MOU is being revisited,” Suhr said. “I have not been a part of that, but again I think we have a real good policy with regard to our intelligence gathering and that does supercede any ask of any other agency. The officers are bound by policies and procedures. And that policy was well thought out with tremendous community and group input years and years ago, from situations that have not since repeated themselves. I think a lot of people back then couldn’t believe they happened in the first place, but I think measures were well thought out and put in place to make sure we don’t have a problem again.”

And at the end of the day, Suhr expressed the hope that his tenure as Chief would endure long after the interim mayor is replaced by an elected mayor.

”I’m a native San Franciscan, and this is a dream come true,” he said. “It’s my first day. However this story ends, with a little bit of luck (raps on the wood tabletop) it’s not going to end today.”

Earth Day in City Hall … on Wells Fargo’s dime

Who was lucky enough to get treated to Mayor Ed Lee’s Earth Day Breakfast in City Hall, with the city’s top politicos and a smattering of high-profile San Franciscans? After noticing that the Board of Supervisors had approved a grant of $12,000 from Wells Fargo a few weeks ago to sponsor the event, the Guardian contacted the Mayor’s Office to ask for the guest list. The response came from the city’s Department of the Environment, which accepted the donation and organized the affair.

The 472-person invite list (we don’t know how many actually attended) included prominent figures such as Sens. Barbara Boxer and Dianne Feinstein, Rep. Nancy Pelosi, billionaire investor Warren Hellman, and former San Francisco Mayor Willie Brown. All 11 members of the Board of Supervisors were invited, too, as were mayoral hopefuls City Attorney Dennis Herrera, Assessor-Recorder Phil Ting, and state Sen. Leland Yee.
 
Invitations were extended to some truly green organizations, too, such as Green for All, Save the Bay, Rainforest Action Network, the Ella Baker Center for Human Rights, the Sierra Club, the Apollo Alliance, Greenaction, and others.

And many seats were reserved for the corporate sector. A total of nine representatives of Pacific Gas & Electric Co. were on the list. There were seven from Cisco, several from consulting and design firm CH2MHill, and a couple representatives from Skidmore, Owings & Merrill — the firm that’s doing the Parkmerced overhaul and which was tapped to envision waterfront venues for the America’s Cup. 

Seven representatives — including the CEO — were invited from Recology, which is in the midst of a debate over its high-stakes, $275 million no-bid garbage contract with the city.

According to Mark Westlund of the Department of the Environment, only half of the Wells Fargo grant went toward the mayor’s Earth Day Breakfast, “the remainder to a series of community events held in the Department’s EcoCenter lobby.” The other sponsors included Blue Shield of California ($2,000); CH2MHill; Skidmore, Owings & Merrill; United Airlines; Environmental Science Associates ($4,000); Levi Strauss & Co.; Cisco ($6,000) and Starbucks — which provided BPA-free travel mugs (double green points!).

It’s nice that San Francisco taxpayers didn’t have to shell out the $18,000 for all these people to celebrate Earth Day together. But at an event such as this, with so many millions of dollars in city contracts and major development projects flying around (not to mention the half a dozen or so people in need of campaign contributions), you can bet they weren’t all talking to one another about saving the planet.

The candidates for mayor of San Francisco are already lining up endorsements — the Sierra Club held its interviews April 23, which seems awfully early to me, since some of the most interesting contenders in this town (Tom Ammiano, Matt Gonzalez) have a tendency to jump in at the last minute. And the filing deadline isn’t until August.

But the sooner the big names and organizations are lined up and the money is locked in, the harder it will be for anyone to pull off an August surprise. So unless the redistricting commission seriously messes with Mark Leno’s state Senate seat or Ed Lee bows to the pressure from Willie Brown, Rose Pak, and their allies and decides to go back on his promise and seek a full term, we’re probably looking at a rough approximation of what the voters will face in November.

With John Avalos in the race, the ballot’s become a lot more attractive to progressives. It’s not as if the other major candidates don’t have a lot to offer, and in some cases, they have a lot to offer to the left. There are smart, experienced, qualified people running.

But let’s be honest here: David Chiu, Dennis Herrera, Phil Ting, Leland Yee, and Bevan Dufty all operate somewhere in the squishy political center, a place where tax breaks for corporations are okay, where “homeownership opportunities” tend to trump the needs of tenants, where deals with big private developers are sculpted around the edges but never rejected outright, and where cuts in services are a larger part of the budget solution than taxes on the rich.

Michela Alioto-Pier is off on the far right of the San Francisco political world, and if she looks at all credible and gets any significant traction (and that’s a big if) she’ll be downtown’s favorite candidate. But until now, there was nobody holding the solid progressive banner.

I don’t think that means Avalos’ appeal is limited to the left; he’s in a swing district, and he’s very popular there, and he can talk about small business and community development and open, honest government. He doesn’t sound like a crazy radical; he’s polite and respectful and listens to people.

But I’m glad we have a candidate who won’t try to argue that 25 percent affordable housing at Treasure Island is something to be proud of, or that the Twitter tax break will create jobs, or that social inequality can’t be addressed through local policy. I’m glad there’s someone who can push the discussion and debate out of the middle, can force some of the others who want progressive support to take strong stands, and can liven things up a bit. Because without him, all of the candidates were sounding a lot alike — and I really don’t want to be bored this fall.

You lose a lot on the left. We all get used to it; we’re fighting against a rich, entrenched power structure and the rules of the game are rigged against us. For people in the labor movement, it’s been a particularly bad year; all over the country, politicians are looking for ways to undermine collective bargaining rights.

So it’s nice to win one every now and then — and it’s nice to be able to say that labor, progressive labor, just won a major victory in San Francisco. But it’s no surprise that the San Francisco Chronicle got the story wrong.

For several years now, the owners of the Fairmont Hotel have wanted to tear down a tower built in the 1960s, eliminate 226 hotel rooms, and build about 160 luxury condos instead. The hotel workers union, not surprisingly, worried about a loss of jobs; condo owners don’t use housekeeping. But it’s a larger issue than that: people who buy hotel condos don’t live there much. Most of the rooms that have been converted nationwide become pieds à terre for very wealthy people. They spend a few nights a year in their units; the rest of the time, the places are empty. Nobody there to shop, eat, or get entertained in SF; nobody spending money here.

So it’s a nice little bit of class warfare: The city loses hotel and restaurant jobs — and part of the city’s tourist infrastructure — so that the owners (including a Saudi prince and Oakland A’s owner Lou Wolff) can make a fast windfall profit. (Think $1 million to $2 million each for 160 condos and you get the picture.)

The owners hired Willie Brown to make their case at City hall; Mayor Ed Lee quickly introduced legislation that would allow the conversion. The Chron picked up the ownership line: only condos can save the Fairmont. “The business has migrated downhill to new hotels near the Moscone Convention Center south of Market,” the paper lamented in an April 17 editorial. Done deal, right?

Well, no. Local 2, the hotel workers union, did an amazing job of organizing, working with Nob Hill neighbors and, by the way, pointing out the facts — the Fairmont has outperformed the SoMa hotels during 10 of the past 11 years, has enviable occupancy rates and stands to reap the benefits of the America’s Cup. Facing a possible strike and a battle royal at City Hall, the Fairmont blinked. The condo plan is dead. Good work, my friends. 

 

Extra! Nevius finds a bad landlord!

Our old buddy C.W. Nevius actually found a landlord he doesn’t like — a guy named Peter Iskander who is trying to toss some seniors and disabled people out on the streets. In a classic bleeding-heart column April 17, he lamented the pending evictions, which would pave the way for the landlord to turn some rental units into tenancies in common:


Imagine the sight of Carlo Tarrone, who is in his 70s and uses a walker, and Sandy Bishop, who is 70 and has lung cancer, forced out of their homes.


Imagine it, Chuck. It happens all the time. It’s been happening for years in this city (and elsewhere), in large part because of the Ellis Act, a truly abominable law that paves the way for landlords to evict tenants and then sell the units for fast cash. Nevius seems to understand that the Ellis Act is behind this particular horror story — but instead of suggesting that the law ought to be changed, he ends his column by suggesting that San Francisco ought to make these sorts of evictions more profitable:


Maybe it is time to start looking at ways to get middle-class buyers into San Francisco real estate. Mayor Ed Lee is looking at a one-time “condo bypass,” an idea floated by Mayor Gavin Newsom in 2010, where tenancies in common residents could pay a large fee to be allowed to convert to a condo. No one would be evicted, and the cash-strapped city could gain millions in fees.


Another plan is “fractional” mortgages for tenants in common. Rather than the old model where everyone in the building is part of a large single mortgage, each unit would have its own mortgage, making it sort of a pseudo-condo.


Actually, Chuck,  both of those plans will make condos and TICs more attractive. That means more evictions of old people — and poor people, and middle-class people who want to live in the city and are getting forced out by somewhat richer middle class people. It’s an awful situation, and what Nevius calls for would just make it worse.


When there’s enough publicity, sometimes bad landlords back off, and I’m sure Nevius will celebrate if that happens as the result of his column. I’ll be happy, too; every inappropriate eviction averted is another small victory. But most tenants don’t get daily newspaper columns written about tham, and you can’t fight this battle one case at a time. You need structural reforms, and repealing the Ellis Act is step one.  




Mayor derails hearing on nightclub crackdown

Will entering a large nightclub in San Francisco be akin to a TSA pat down? We won’t know for a while, as the proposal for heightened security measures by San Francisco Police has caught the interest of Mayor Ed Lee and further discussion has been stalled pending his analysis.

A hearing last night (Tues/12) at the Entertainment Commission proved to be a disappointment for the dozens of people who attended in hopes of getting closure on the hotly contested proposal, which has drawn criticism for its infringement on freedom and privacy and burdensome cost to club owners, as well as being the latest battle in San Francisco’s War on Fun.

“We need to protect our events,” said Liam Shy of the organization Save the Rave, a coalition of people dedicated to keeping electronic dance parties alive. “They are in a state of crisis right now, and this would make it much worse.”

Shy and fellow Save the Rave member Matt Kaftor saw the mayor’s interest in the issue was a good indication that community dissent has been heard.

“I would be truly shocked if this passed,” said Kaftor. “If it does, we will be protesting constantly.”

The proposal would require all venues with an occupancy of 100 or more people to record the faces of all patrons and employees and scan their IDs for storage in a database, which would be available to law enforcement on request for at least two weeks. Metal detectors, security cameras and brighter lights in the venues would also be required. The proposal was created in response to recent violence in and around nightclubs, most notably the shooting outside Suede in Fisherman’s Wharf last year that resulted in the closing of the club.

However, critics say this is an overreaction that unfairly targets events as sources of violence.

“What I keep getting from measures like this is that police work is hard,” said SF resident Jonathan Duggan. “But instead of doing their hard work, they are just creating another avenue for privacy invasion that shifts the responsibility to everyone else.”

Although the main target is nightclubs, many events in San Francisco would be affected. Events with strong cultural, ideological, and political components are frequently held at venues that would be affected by these rules.

Eva Galperin of the Electronic Frontier Foundation showed up last night prepared to give the commission a piece of her mind. She shared a letter with us outlining her concerns, which listed the support of many other civil liberty and privacy protection groups such as the Bill of Rights Defense Committee.

“The city of San Francisco has a long history of political activism and cultural diversity which would be profoundly threatened by this proposed rule,” Galperin wrote. “Scanning the IDs of all attendees at an anti-war rally, a gay night club, or a fundraiser for a civil liberties organization would result in a deeply chilling effect on speech…This would transform the politically and culturally tolerant environment for which San Francisco is famous into a police state.”

District 8 Supervisor Scott Weiner, who has been instrumental in the effort to keep events in San Francisco alive, told us that he does not support the proposal. His resolution to protect events passed the Board of Supervisors on March 29 and focuses on collaboration between city agencies and nightclub owners to combat violence rather than simply cracking down on entertainment venues.

 “It’s one thing for a large club with a history of problems to receive those kinds of exceptional security measures, but for the majority of clubs, it strikes me as overkill as well as invasion of privacy,” Weiner told us.

Jocelyn Kane, executive director of the Entertainment Commission, could not give any indication as to when another hearing would be or what prompted the mayor’s decision.  Neither she nor the mayor’s office could elaborate on whether the mayor has problems with the proposal or is simply responding to the public outrage.

Supes vote on Botanical Garden fees

The Board of Supervisors voted on April 12 to keep in place nonresident fees at the San Francisco Botanical Garden for at least another two years, rejecting a proposal by Sup. John Avalos to do away with the fees and make up for the shortfall with a portion of revenues brought in by a real-estate transfer tax that was approved by voters last year.

Advocating for his position, Avalos stood to tell a story about his last visit to the Botanical Garden. “A couple months ago, I was able to go there with my kids,” he began. “I went in, I was asked for my ID, I showed my ID. I noticed the next person who came in after me looked very agitated when she got to the gate. She said the F-word very loud, and she started to walk away. I approached her, and I said, ‘hey what’s going on?’ And she said, ‘I come here everyday, and I’m being asked for my ID, and I have to go back to my house to get it because I don’t have it with me today.'”

She wasn’t the only person who seemed disgruntled by the gatekeeper that day. “On my way out, I noticed a few tourists coming up,” Avalos continued. “It looked like they were from Germany. They walked up to the gate and then they walked back away from the gate. They clearly did not go in because they did not want to pay the fee.” A couple in their 60s tried to enter, but they did not go in because they didn’t have their IDs proving that they lived in San Francisco, he added.

Bottom line: “The gate and the fee has really diminished what people’s enjoyment of the park has been like for decades,” he said. “Can’t there just be one fee that we don’t raise? Can this be that one fee? I don’t think that’s asking too much.” He also noted that budget analyst’s report showed that the fees did not bring in the revenue that had been anticipated, a point echoed by Sups. Ross Mirkarimi and David Campos.

Yet Avalos’ pitch wasn’t enough to persuade his colleagues. On the question of whether money from the real-estate transfer tax revenues should be used to make up for the nonresident fees so that the Botanical Garden could be free for everyone, supervisors said no on a 7-4 vote, with Sups. Eric Mar, Mirkarimi, Campos, and Avalos voting yes.

The board also voted on whether the nonresident admission fees should be extended beyond June 30, 2011 (a date set when the fee was initially imposed), as proposed by Mayor Ed Lee. Board President David Chiu offered an amendment that the fees would only remain in place for two years, after which point the debate could be rehashed. The amendment was adopted, and the mayor’s proposal passed on a 6-5 vote, with Sups. Jane Kim, Mar, Mirkarimi, Avalos, and Campos voting no.

So, that’s how it went down at the board. If you’re a nonresident, the Botanical Garden still isn’t free.

Since Kim and Avalos both shared their accounts of visiting the Botanical Garden, I thought I’d share my own photos and impressions from a visit on a recent afternoon, when I had several hours to myself to explore Golden Gate Park’s haven of greenery. Admission was free, since I’d planned ahead to bring my ID.

The day was sunny and warm, and I spent a long time photographing the light streaming through a cluster of bamboo and sitting by a pond watching some water bugs skip around on the surface. It was a welcome escape from city life with an element of educational value, since all the plants are labeled with plaques identifying their Latin names, common names, and places of origin.

I noticed two people sitting wordlessly together in the sun. The woman, who seemed to be a caregiver, was seated on a bench, and beside her was an elderly man in a wheelchair with a blanket over his lap. The man seemed to be very frail. Yet he wore a serene expression, and was clearly enjoying the calm and quiet afternoon.

I don’t know if they paid to get in or not. As Board President David Chiu noted at the meeting before voting in favor of keeping the fee in place, “We don’t live in a perfect world.” You can argue about the privatization of parks, or about the need to find all possible sources of revenue in order to fend off cuts to city-funded services. Nevertheless, it’s sad to think of the folks who would be barred from the simple pleasure of sitting in the sun surrounded by natural beauty, because they can’t afford to pay.

Question time’s a waste of time

I strongly supported the measure that mandates that the mayor of San Francisco appear before the supervisors once a month to take questions. But the rules adopted by the board — with waaay too much consultation between Mayor Ed Lee and Board president David Chiu — have turned this great idea into a farce.


The supervisors have to submit questions in writing a week in advance. The mayor in essence stands there and reads pre-written answers. Aaron Peskin, one of the backers of question time, sent a text to Sup. Chiu’s office during the April 12th board meeting and made the point:



“Your idiotic question time rules have led 2 an absurd charade of folks reading (poorly) 2 eachother.  What a joke.” 


It’s embarassing. The board needs to rewrite the rules, now, and allow some actual interchange and debate, which is what the whole thing was supposed to be about in the first place.

No cuts-only pension deal

EDITORIAL Mayor Ed Lee has released a draft set of proposals for pension reform, and union leaders continue to meet with financier Warren Hellman to try to craft an alternative. Meanwhile, Public Defender Jeff Adachi is narrowing his options and appears ready to move forward to put his own plan on the ballot.

Everyone involved claims to be interested in a compromise, in some proposal that would reduce the city’s burden of paying $350 million this year (and potentially as much as $790 million in five years) into the employee pension fund. We support that idea, too — there are plenty of necessary, progressive moves to fix the city’s pension system and free up more cash for local programs.

But so far, none of the proposals on the table include any new revenue sources — which means, in effect, that the mayor, Hellman, and Adachi all want city workers to bear the entire brunt of the impact of a Wall Street-driven recession. The message: only city employees should share the pain; the wealthiest San Franciscans and biggest, richest businesses don’t have to contribute at all.

It’s a dangerous part of the tax mythology that Pulitzer Prize-winning reporter David Cay Johnston discusses in his article in the Guardian this week. He notes that the argument in favor of tax cuts for the rich — that lower taxes will lead to more investment and thus more jobs — has been tested in this country for 30 years. And it hasn’t worked.

Most San Franciscans probably realize that. Most city officials vote for Democrats, opposed the Bush-era tax cuts on the rich, and argue for more federal aid to cities. This is a progressive town.

But when it comes to something as fundamental as local economic policy — who pays for city services and who gets the benefits — the story becomes completely different.

The mayor and eight of the 11 supervisors are celebrating a broad-based tax cut as a way to create jobs in the Tenderloin and mid-Market (although the evidence that tax cuts don’t create jobs is overwhelming). The mayor is looking at the equivalent of a cuts-only budget (although everyone at City Hall opposes the notion of a cuts-only budget in Sacramento). And while it’s almost certain that some sort of pension reform will be on the November ballot, none of the players involved in the negotiations have openly taken what seems to us to be the only logical position:

Pension reform has to be linked to tax reform — a commercial rent tax, a progressive gross receipts tax, a city income tax, an increase in the Pacific Gas and Electric Co. franchise fee or something else that hits those who can afford to pay. Otherwise, we can’t support it.

Even the city employee unions are being awfully quiet about the need for a deal that includes new taxes. They ought to be leading the charge here, telling everyone that a cuts-only pension deal isn’t going to be acceptable. (The tax measures could hold until the November 2012 budget, when they’ll be easier to pass — if there’s a firm assurance that the mayor, Hellman, Adachi, the supervisors, and all the other players will support them.)

City employees are being asked to take what amount to pay cuts — which will reduce their purchasing power and have a depressing impact on the local economy. Taxing the wealthy (who spend a much smaller percentage of their income) has no such depressing impact. Those are hard, cold facts. They need to be part of the discussion.

Robert Reich, the former labor secretary who now teaches at the University of California, Berkeley, has an interesting essay on his blog April 9 that discusses Obama’s budget capitulations. The president, he notes, “is losing the war of ideas because he won’t tell the American public the truth: that we need more government spending now — not less — in order to get out of the gravitational pull of the Great Recession. That we got into the Great Recession because Wall Street went bonkers and government failed to do its job at regulating financial markets … That the only ways to deal with the long-term budget problem is to demand that the rich pay their fair share of taxes.

“And that, at a deeper level, the increasingly lopsided distribution of income and wealth has robbed the vast working middle class of the purchasing power they need to keep the economy going at full capacity.”

That’s as true here as it is in Washington. And if city officials want progressive support for pension reform, they need to acknowledge it.
