The Queer Issue: Back to the future?

I’m supposed to meet my editor, Marke B., to talk about this piece at noon at some cheap Mission restaurant that won’t bankrupt my lousy checking account. I arrive 15 minutes late; he’s running at least 30 behind. As I sit and wait for him, I can’t help but laugh — queers are always late. As a queer with a drag-queen alter ego, Felicia Fellatio, I know this is especially true — that hoary old chestnut about "running on drag time" has the ring of solid validity. Trannies are like Muni: we’re never on time.

But a growing body of scholarly queer literature suggests that the underlying cause of our tardiness may be more than simply wanting to be fashionably late. In fact, our predictable lack of punctuality might be a symptom of what many psychologists see as the gay community’s prolonged adolescence; there may be a sense of time unique to homos that exists outside heterosexual norms.

WIND IT UP


Put simply, queer temporality theory says that because our lives can’t be completely legally or socially mapped out according to the heterosexual model (getting married, having kids, sharing retirement benefits, expecting inheritance), we feel less pressure to conform to other aspirations (completing a degree, saving for a house, planning retirement) in the stereotypical Game of Hetero Life. Basically, tardiness is a form of subconscious queer rebellion. This can manifest itself as a rejection of all schedules, however quotidian. It can also lead to a profoundly different view of what the future means to queer people, especially in terms of freedom of choice. Well-known queer theorist Judith Halberstam elaborates on this theory, from a transgender point of view, in her book In a Queer Time and Place: Transgender Bodies, Subcultural Lives (New York University Press, 2005).

Some studies also posit that, because many of us grappled with the whole coming-out thing at the same time we were going through puberty, our adolescent maturation period was extended, thus stretching out our psychological development — and effectively slowing down our mental clocks. We just need more time to process things and act on them. Other queer temporality theories focus on the psychological effects of AIDS, which instilled in our community a sense of imminent mortality that negated the future and focused our attention on the present. Rather than making decisions based on what may be, we began to concentrate on what is, creating art and culture that offered immediate transcendence through humor and rage, rather than any abstract hope for the future. "AIDS quickens that sense of needing to and actually being able to draw forth from one’s spirit that work which will have resonance for other people," the late, great filmmaker Marlon Riggs said, and the recent work of performance studies scholar José Esteban Muñoz tries to show how queers have incorporated that sense of "quickening" into their lives and actions.

SPRUNG FORWARD


Of course, we may just run late for things because we’re busy, either at work (most of us rely only on ourselves for financial stability) or at play (our culture is still pretty party-centric, so we have a lot of hangovers to deal with). Plus, putting on all that makeup is practically a full-time job for us queens. Cut us a little slack so we can look fabulous. And all of the theories above seem awfully generalized — some may bristle at the suggestion that we be cast as supposed victims of a pathology that prolongs our adolescences and screws with our mental clocks. It’s not as if there aren’t queer people living as much as they can according to the hetero model, especially now that legal restrictions against same-sex marriage and adoption are relaxing in some areas.

In fact, the pendulum seems to be swinging the other way in terms of the queer rebellion against the straight timeline. As noted by broadcast journalist Tovia Smith last month on National Public Radio, in her piece "Marriage Causes Shift in Gay Culture," it seems that queers have gone "from a radical movement bent on challenging societal norms to a community now eagerly embracing those conventions as their own."

Smith drew her conclusion based on an interview with an upper-middle-class white gay couple from Cambridge, Mass. — the type of control group against which queers have traditionally defined themselves. Whatever negative connotations the phrase "prolonged adolescence" may conjure up, a case could be made that this is precisely what allows queer culture to thrive. Adolescence is when a personality is at its most fluid, and queer identity is the essence of fluidity. Halberstam sees queer temporality as a positive, radical reaction to heterosexual society’s mores, pitting it against the "time of inheritance," whose purpose is merely to shore up "the historical past of the nation" and protect "national stability." In the ’90s, a vibrant queer culture of artistic expression, political activism, and social and sexual interaction embraced the notion of prolonged adolescence.

FALLING BACK


Queercore bands like Pansy Division and Tribe 8 co-opted the in-your-face, live-fast-die-young aesthetic of punk, inviting listeners to throw off the shackles of heterosexual society’s expectations and, in the words of Pansy Division, "join the cocksuckers club." Homocore fanzines reveled in childlike graphics and gleefully reinterpreted teen fan magazines like Tiger Beat, giving them a decidedly homosexual spin. The hallmarks of puberty — geeky awkwardness, swoony crushiness, questionable outfits, wanton partying, sexual exploration — became queer fashion statements. Prolonged adolescence was also a means of connection in a time of grief and frustration, a flashpoint where queer history met the present. The AIDS Quilt used a common symbol of childhood comfort to unite and console mourners, and activist organizations like ACT UP and Queer Nation energized their members with the élan of belonging to a rebel schoolyard gang.

But that was the past, and there’s no denying that, with more access to the heterosexual lifestyle opening up for queers, the future is upon us. HIV is no longer a death sentence (for people who can afford the meds), and any evidence of necessary rebellion is awfully hard to find in young gay people these days, at least on the face of it. Prada and Beyoncé have replaced vintage clothing and queercore as coins of the young gay realm, and the psychological and social effects of the current lust for consumerism and mainstream pop culture on queers today will be for future theorists to puzzle out. To me, it represents a sad trend that aspires more toward societal acceptance than political subversion, an adjustment of our internal clocks to tick to the tired straight beat. Call me nostalgic, call me behind the times — just don’t call me late for cocktails.

One of the most entertaining books ever written about the commercial theater is Ken Mandlebaum’s Not Since Carrie: 40 Years of Broadway Musical Flops (St. Martin’s, 1992). There’s something inherently fascinating about the backstories and eventual fates of big stage musicals. The egos involved and the radical revisions that take place during tryouts and previews (a process far more public than movie retweaking) make for high drama, even before you add the Russian roulette economic factor.

While Mandlebaum wrote from a dedicated fan’s orchestra-seat perspective, the absorbing new documentary ShowBusiness: The Road to Broadway goes way backstage — director Dori Berinstein is a Tony-winning stage producer (her latest hit is Legally Blonde) and has privileged access. Her team reportedly shot more than 250 hours of footage, encompassing virtually every Broadway show of the 2003 to 2004 season, then narrowed the focus to the development and destinies of four high-profile musicals.

The quartet spotlighted here spans artistic ranges and commercial fates. The $14 million spectacular Wicked, a schlock-sentimental version of Gregory Maguire’s revisionist Oz fantasy, got no critical love during its closely observed San Francisco tryout — erstwhile Godspell composer Stephen Schwartz admits to making significant changes between that run and the Broadway opening. But while Wicked proved neither a reviewers’ nor a Tony favorite, it’s a rare case in which those factors don’t matter. It’s a massive million-dollar-a-week hit whose geek-empowerment message particularly resonates with younger girls. Those whose parents can afford Broadway prices, that is.

On a whole other plane, the Tony Kushner–Jeanine Tesori project Caroline, or Change was an emotionally complex, stirring, major high-culture event. Its producers, as New Yorker critic John Lahr puts it, "agreed to lose a little money so this very good thing which doesn’t fit the commercial formula [could] be seen." If only for a few months: with its more bitter than sweet emphasis on racial inequity and family dysfunction, no amount of acclaim could turn it into a tourist attraction.

While practically a Broadway bargain at merely $3.5 million in production costs, Avenue Q was considered the season’s longest shot — a Sesame Street parody whose relatively youthful target audience isn’t big on theatergoing. Wags anticipated an off-Broadway show that belonged off Broadway. Its triumphant critical reception and eventual clutch of Tony Awards turned such expectations upside down. Cocreators Jeff Marx and Robert Lopez are the giddiest protagonists here, their can’t-believe-our-luck exuberance offering a contrast to the sober insights delivered by such experienced hands as Schwartz and Caroline‘s director, George C. Wolfe.

Finally, there’s Taboo, a $10 million total loss for producer Rosie O’Donnell, who shepherded it to Broadway after loving a smaller-scale London staging of the gender-bending, Boy George–scored musical. Was it just too gay for Broadway? (No, that’s not an oxymoron.) Was it simply not very good? (A devoted cadre of mostly punk-goth fans would vehemently disagree.) Did negative press attention to O’Donnell and an apparently turbulent production process unfairly brand it a flop before the opening? We may never know — Taboo sure ain’t coming to a theater near you anytime soon. One of ShowBusiness‘s most poignant threads focuses on young unknown Euan Morton, who wins raves in a star part in the huge show. After its closure, his US work visa is revoked; he’ll have to restart his career back in England from square one.

ShowBusiness covers everything from playwriting to rehearsals to street buzz to critics, but one wishes it had more depth. Berinstein’s insiderdom gets her access but perhaps also limits her willingness to bare all. Clocking in at 102 minutes, her documentary is almost a dirt-free zone. It’s refreshing when Marx and book writer Jeff Whitty admit they could barely stand each other while collaborating on Avenue Q — though success certainly improves their rapport. And ultimately, their multiple Tony Award wins provide a dramatic highlight. At the ceremony, Carol Channing and LL Cool J copresent an award. It’s a showy moment whose mix of the sublime and the surreal encapsulates how unpredictable the business Berinstein examines can be. *

Green libertarians

TECHSPLOITATION It sounds crazy, but it just might work: green libertarianism could become the new reformist movement in politics and cultural life.

In the 1980s, suggesting that green culture could be combined with libertarianism would have been worse than foolish. Those were the days when libertarians protested having to get their cars smog-checked because it represented government control of their personal property. But now that even staunch Republicans like Governor Arnold Schwarzenegger are promoting ecofriendly policies and business leaders like Silicon Valley venture capitalist Vinod Khosla are hanging out at the Sierra Club, it seems that the times, they are a-changin’.

Over the past decade, experts have slowly and quietly been publishing studies on how to bring green sensibilities into line with the free-market agenda of libertarians. Natural Capitalism, published in 2000, was one of the first books to advance this idea. Last year two Yale environmental researchers, Daniel Esty and Andrew Winston, published Green to Gold, which explores ways that companies like Wal-Mart are attempting to bring sustainability into their business models. Though Esty and Winston conclude that there are no companies currently doing enough to be truly green, they acknowledge that some are on the right track.

They also explain quite succinctly why free-market leaders have joined what they call the Green Wave. No, it’s not out of the goodness of their hearts. "Behind the Green Wave are two interlocking sources of pressure," they write. "First the limits of the natural world could constrain business operations, realign markets, and perhaps even threaten the planet’s well-being. Second, companies face a growing spectrum of stakeholders who are concerned about the environment."

A lot of Green Wave entrepreneurs are probably disingenuous. One imagines they’re like the antihero of underrated movie I Heart Huckabees, a slimy corporate type who feigns interest in green development to sucker a community into signing over its land to condo and mall developers. But I believe some real-life Green Wavers are genuinely fascinated by strange new ideas that could encourage economic growth and sustainable development. These are people who are talking about carbon credits, emissions trading, and various financial incentives for entrepreneurs who limit their environmental impact, recycle, use alternative energy sources, or encourage their employees to carpool.

The question is why would anybody want to marry green and libertarian values? It sounds like a way of letting business do an end run around international bodies and governments, groups that have traditionally set limits on industry. There’s no doubt that states should have a role in setting policies for local corporations, but those corporations need rewards for their good behavior too. That’s where capitalism comes in. Combining libertarianism with green values might be a pragmatic way to convince some of the worst polluters to cut back by essentially bribing them with cash. The state can step in to punish bad actors who refuse to try for the carrot.

On a less cynical note, one might say that libertarians and greens go together because both are focused on maintaining economic development in the long term. They aren’t looking at next quarter: they’re looking at next century. A green libertarian has realized that the freedom of future markets depends on maintaining a healthy environment.

If green libertarianism prevails, I’m guessing the future will look nothing like ecotopia and nothing like capitalist Utopia either. Business will behave more like government, limiting its growth for the sake of sustainability. And ecology as we know it will probably be a lot more engineered and synthetic than ever before because communities will carefully plan their ecosystems to remain healthy and whole alongside cities and corporations. We will reach a stage in our technological development when we have to manage our natural environments as well as our economic ones. Perhaps one day the capitalism that results from green libertarianism will know itself to be only one piece of a healthy social ecology. That’s the kind of capitalism that even a grumpy old Marxist like myself can get behind. *

Hole in the street

It was warmer than usual that Saturday morning in Golden Gate Park. Peter Cummings woke up behind a bush, took his shirt and shoes off, put on his headphones, and staggered down the hill with a bottle of whiskey and a big smile on his bearded, dirt-stained face. He sat down on the bench at Stanyan and Hayes and greeted passersby in his usual charmingly rambunctious way. For the past seven years, this had more or less been his daily routine.

The only thing that made this day different was the food and the heroin. That morning Cummings skipped breakfast. He usually went to the corner deli to buy some bread and soup, but not this particular Saturday. Then, around 2 p.m., a couple guys walking down the hill found Cummings convulsing in a quiet nook behind a fallen log. One of them gave him CPR and a Narcan shot, and a couple others ran across the street to St. Mary’s Medical Center to get the paramedics. But it was too late.

Hundreds of homeless people die every year in San Francisco, and many of them leave our world silently and with little impact on the city. But the loss of this particular alcoholic, bipolar, homeless man changed the landscape of one San Francisco neighborhood. As Gavin Newsom’s administration aggressively pursues its 10-year plan to abolish chronic homelessness, this man’s legacy shows how someone living in the park may actually be a good thing — if not for himself, then at least for the community.

"He watched out for me," Cirrus Blaafjell, who lives in the neighborhood, told the Guardian. "Some of the guys would harass me when I came out here at night to walk the dogs, and Pete would yell at them, ‘Leave her alone. She’s a nice person!’" When University of San Francisco student Amanda Anderson was followed through the park one day by a seedy character, Cummings launched his own inquiry. "Who tried to hurt Amanda? I’m gonna beat his ass when I find him!" Cummings yelled into the trees.

Even certain city officials agree. "He did seem to keep all the other drunks in line," Officer John Andrews of the San Francisco Police Department told us. "A lot of times when we had a problem, he’d come around and say, ‘Hey, Andrews, we’re taking care of things. Don’t worry.’ If someone was really intoxicated, he’d take them into the bushes. And he never argued with anyone."

The federal Department of Housing and Urban Development considers people to be chronically homeless if they’re alone, disabled, and have been sleeping on the streets or in shelters for a year straight or intermittently for three years. Newsom’s initiatives aim to put all 3,000 chronically homeless residents of San Francisco into permanent homes by 2014. "It’s a concept based on Malcolm Gladwell’s Tipping Point," Angela Alioto, the chairperson of the 10-year plan, explained. "If you take care of those who are the most chronic and use the most resources first, you will tip the scale of the whole problem."

But the Coalition on Homelessness, a nonprofit advocacy group, disagrees. "The phrase chronically homeless is misleading," director Juan Prada told us. "Chronic makes you think of general health issues, so you create an impression that homelessness is a condition. We see homelessness as a systemic failure to address poverty and the lack of housing."

Cummings, who lived in the park for the past seven years, was definitely chronically homeless. But had he survived another seven years to see the mayor’s initiative come to fruition, he may not have ever accepted the helping hand. "I live here by choice," Cummings once told me. "I have money, I have a place to go. I just like it here."

The corner of Stanyan and Hayes is almost never quiet. Belligerent drunks, ambulances speeding to the emergency room half a block north, and road-raged drivers blaring their horns at a badly designed left turn are part of the daily ruckus. Cops show up regularly. "People would call us about trash and shopping carts or about drunks yelling and screaming and fighting each other," Andrews told us. "And you have all types of guys up there in the horseshoe pit."

Hidden amid the trees in the northeast corner of Golden Gate Park, the horseshoe pit is known as a gathering place for hardcore drug users. Nothing remains of its original incarnation except some rusty equipment and a faded life-size mural of a horse. Today it’s a haphazard jumble of used needles, sleeping bags, and seedy characters often too messed up to talk. Despite having this hub as his home, Cummings stayed relatively drug-free for the past four years. And between his Veterans Affairs and Social Security checks, he was bringing home about $3,000 a month. Instead of paying rent, Cummings used his income to buy liquor for himself and food for everyone in the park. "Where does all my money go?" he used to ask people walking their dogs as his friends munched on hot dogs and piroshkis on the grass behind him.

"He used to buy cartons of milk and leave them quietly next to people who he thought would need it," remembers Jerry, a 52-year-old chronically homeless man and one of Cummings’s best friends.

Cummings kept his past well hidden from his park friends, but when he died, dozens of people in the Upper Haight–North Panhandle area came out with stories about him from the past two decades, back to a time when he was sober, happily married, and a model member of the community.

"People used to call him the mayor of Cole Valley," said Jacob Black, a cab driver. "He knew everybody in town."

Cummings was born in Melrose, Mass., on March 11, 1954. He lived there with his parents and two siblings until his father, an engineer at a forklift company, was transferred to Oregon in 1971. "[Peter] picked on me a lot, but I always outsmarted him," younger brother Rick Cummings, who is a sales rep in the health care industry, told us. "It was a typical brotherly thing." Cummings joined the Coast Guard at age 20 and developed a lifelong love for the ocean while stationed in Hawaii and Guam. He was honorably discharged in 1978 when he injured his knee on an open hatch cover.

For the next couple years, Cummings wandered around Northern California, growing pot and mushrooms in the mountains and sleeping on the beach. "He always attacked me for my middle-class, suburban lifestyle," Rick says. "He never wanted that." For most of the ’80s, Cummings lived under a seedy bridge in downtown Portland, with a heroin addiction and early symptoms of bipolar disorder. He ended up in San Francisco, where he decided to give sobriety a shot. As Rick said, "He had it together enough mentally to know that he had to either get cleaned up or die."

Once in San Francisco, Cummings took lithium for his bipolar disorder, joined Alcoholics Anonymous and Narcotics Anonymous, and by all accounts stayed sober for almost 14 years. For the first time in his adult life, everything was going really well. He got married to a beautiful Peruvian woman, rented an apartment in Cole Valley, bought a used Jaguar and a Boston whaler, which he took out for salmon fishing in the bay, and was constantly surrounded by a solid group of friends. He even worked as a drug rehab counselor at the Haight Ashbury Free Clinics.

Cummings was known among AA and NA circles as a handsome, spiritual role model with a killer sense of humor who always brought fresh fish to barbecues. "When I got sober, I was living on the streets and hated life," friend Dana Scheer says. "Pete reached out to me as he did to countless people. He was like a sober guru to me — I knew him as a very stable, rock-solid person."

Then, around 1998, things started to go downhill. His AA sponsor died of cancer; his wife left him; and the VA screwed up his bipolar meds. Cummings became increasingly isolated. He stopped attending meetings and moved out of the Haight, first to work as a building manager in SoMa and then to pursue a love interest in Mill Valley. "I went over to visit him one day, and he was drinking Coors," Scheer says. "This was my mentor from AA, so it was a little bit shocking." When Scheer left that evening, Cummings gave her a few of his belongings, including a stack of blankets. "I thought that was significant, because he always took care of me," Scheer says. "Blankets symbolize warmth and comfort, and he had always given me that. That was the last time I saw him before he ended up on the street again."

Cummings returned to the Haight around 2000, but this time he was drunk and high and incoherent. "When you’re that kind of addict, you don’t just start drinking a little wine," Scheer says. Cummings eventually ended up at the horseshoe pit, where he was reunited with some old AA friends who had also relapsed. And that’s where he lived for the last seven years of his life.

Despite recent city efforts to abolish camping in Golden Gate Park, Cummings continued to live in the bushes, often changing location to avoid getting caught. "It’s completely illegal for people to live in the park," Rose Dennis, director of communications at San Francisco’s Recreation and Park Department, told us. "But if you’ve been on the streets for seven years, you become resilient."

Alioto told us she has no problem with homeless people not wanting a roof over their heads. "If a person truly wanted to live on the street, there is nothing we can or should do," she told us. "They have a constitutional right to live and travel."

On the outside, Cummings the homeless guy was nothing like Cummings the sober guru, but he continued to help people with drug and alcohol problems. "Peter helped a lot of kids get out of bad situations," Jerry told us. "He was in the Coast Guard, so he knew all the vital signs. He saved a lot of lives, including mine — twice. I owe him a pair of Levi’s from the time I bled all over his after falling down a 30-foot cliff."

Cummings apparently overdosed just a few feet south of the horseshoe pit that had seduced him back into this lifestyle. The week after Cummings died, the Hayes entrance of Golden Gate Park was eerily quiet. "The park is like a cemetery," Jerry said with tears in his eyes. "Everyone’s walking around like corpses." His homeless friends scattered to mourn the loss of a friend and source of nourishment in their own way. "When you’re living on the streets, people are dying left and right," Scheer says. "And when that happens, you just want to get loaded and forget about everything."

Residents of the North Panhandle didn’t have a reason to stop here anymore either." I used to sit on the bench and just talk to him," Christian Blaafjell says. "He was crazy, but he was great. I miss him." Even Andrews is well aware of the impact Cummings’s passing will have on the community. "He was the leader of this pack," he says. "I don’t know what’s going to happen to these guys over here." He pauses. "Hopefully, they’ll leave."

The sight of Cummings limping down Hayes Street might have looked bad for the city, but the services he offered to its most fallen people were indispensable. "Maybe he was just doing his job," says James Warren, a friend from Cummings’s AA days. "Maybe what he learned from the program, he took to the streets. Pete took his legacy, generosity, love, and compassion back to the streets so that they might know that there was a better place and that he’d been there. I know I wouldn’t have made it through if it wasn’t for him." *

Peter S. Cummings died May 5 in San Francisco. He is survived by his parents, Richard and Nancy; his sister, Pam; his brother, Rick; and dozens of friends.

One night last September, I hitch a ride with G-Stack of the Delinquents and Dotrix of Tha Mekanix to Dem Hoodstarz’s album release party in San Francisco. As we park outside the club, Mistah FAB rolls up with a modest posse. In contrast to his usual iced-out Technicolor clubwear, the man also known as Fabby Davis Jr. is low-key, dressed all in black, a pair of designer stunna shades supplying the main clue to his identity. He hops in Stack’s car to hear a newly laid track for the latter’s upcoming Purple Hood, then we set out for the club, a less than half block journey whose distance is lengthened interminably by a series of well-wishers and business consultations. It’s like following two CEOs across the floor of the stock exchange: Stack is on two cell phones, trying to shake hands with someone. FAB, meanwhile, handles minor transactions, poses for a photo, and takes a call, all while briefing me on the deal he had just signed with Atlantic Records for Da Yellow Bus Rydah, the much-anticipated follow-up to his 2005 disc, Son of a Pimp (Thizz Ent.).

Near the door, a man takes FAB aside. "FAB, you gotta do something about the violence," he says, meaning specifically the 141 homicides in Oakland in 2006 under former mayor and present attorney general Jerry Brown. FAB nods at what is clearly an unreasonable request, albeit one that reflects the disproportionate political burden borne by black entertainers in America. No one would turn to, say, Justin Timberlake to stop violence. Then again, I imagine no one asks Keak Da Sneak either. FAB’s position, in other words, is unique.

Though he made his early reputation as a freestyle battle rhymer and owes his success to hyphy hits like "Super Sic Wit It," FAB’s lyrics seldom stray into gangsta or pimp terrain — the title of his last album is simply literal. Yet he can get down on a track with the most thugged-out MCs. Aside from the giants Too $hort and E-40 and on par with the perpetually hot Keak, FAB is the rapper all Bay Area rappers want on their albums, because he has the biggest buzz on the radio and in the streets. His popularity gives him influence, but FAB commands respect in the hood because he’s from the hood: his compass-based hit "N.E.W. Oakland" was the first major rap recognition of his native North Oakland as a hood. This rapport with the alienated and isolated ghetto youth who constitute hyphy’s core audience separates him from the vast majority of MCs to whom the label "conscious" may be applied.

"You go up to someone in the hood and be, like, ‘Dick Cheney had a heart attack,’ they be, like, ‘Who the fuck is Dick Cheney?’" FAB says later. "But you tell him, ‘Jay-Z donated a million dollars to improve water in Africa,’ they be, like, ‘For real?’ That’s something of their world. Being a Bay Area artist, I’m of their world. So you have the opportunity to teach without them knowing."

"People who have influence," FAB continues, "have an obligation to tell people, ‘Preserve life. Save lives. Help lives.’ But it’s hard to reach people if you’re not giving them something they relate to. The hyphy movement is something they relate to. Hyphy gets you in the door, to open their ears to what I’m saying. It’s up to them to digest it."

That night at the club, FAB exerts his influence. When things get salty between security and Dem Hoodstarz’s East Palo Alto associates, the group calls FAB to the stage to perform their collaboration "Ugh." Things chill out. FAB issues an impromptu plea against violence and murders. These are problems no single person can solve, but FAB is doing his part. Yet by the show’s finale — the "Getz Ya Grown Man On" remix, on which he has a verse — Fabby Davis has left the building. Being Mistah FAB, I realize, can be exhausting.

FOLLOW THE YELLOW BUS ROAD


Mistah FAB’s deal with Atlantic is a landmark in a scene long neglected by the majors. Along with Clyde Carson’s signing with Capitol, FAB’s arrangement — including distribution for his Faeva Afta Entertainment — is the first serious acknowledgment of the renaissance Bay Area rap has undergone in the past three years. Unlike E-40, a regional star who’d already achieved putf8um sales on Jive before his push last year by Warner Bros., FAB’s an unknown quantity outside the Bay. And in contrast to Frontline or the Federation — whose deals came through the respective backing of nationally known producers E-A-Ski and Rick Rock — FAB is the first evidence for a new generation of local rappers that enough talent and dedication can get you signed. It’s another weight on the shoulders of the man born Stanley Cox Jr.

"Lots of people are putting their hopes into the album," he acknowledges. "They’re, like, ‘I hope FAB do it, because it’ll kick in the door for all of us.’ I realized when I was creating this album it’s not just something I want to do. It’s something my whole region depends on."

Da Yellow Bus Rydah‘s journey has been anything but smooth, however. Bottom line: Atlantic has postponed the album’s tentatively scheduled spring release, due to controversy surrounding the Ghostbusters-themed advance single, "Ghost Ride It." A tribute to the hood-invented practice of throwing your car in neutral as you walk alongside and steer, "Ghost Ride It" was generating a buzz through its a video on YouTube and the minor-league MTVs when a Dec. 29, 2006, Associated Press story ("Hip-Hop Car Stunt Leaves 2 Dead") linked the song with a pair of unrelated deaths: Davender Gulley, 18, of Stockton, who "died after his head slammed into a parked car while he was hanging out the window of an SUV," and an unnamed "36-year-old man dancing on top of a moving car [who] fell off, hit his head and died in what authorities said was Canada’s first ghost riding fatality." While the scant details obscure whether these incidents stemmed from ghost riding or more traditional automotive horseplay, Fox News’s Hannity and Colmes found the trend alarming enough to call FAB on the carpet in January.

"You understand that a lot of kids look up to you?" Sean Hannity accused rather than asked FAB. "They sing your songs. They dress like you. They talk like you — they wanna be you!" Aside from displaying an oversimplified sense of the relationship between artist and audience, Hannity’s remark reveals a comic lack of familiarity with hip-hop and their guest in particular: what part of "Super Sic Wit It" do you sing? Moreover, while rap fans undoubtedly draw from the same well of slang, the idea that they all talk the same — or even like FAB, for that matter — is a stereotype.

"I don’t think they expected me to be so articulate," FAB recalls with a laugh. Yet among MCs, FAB is singular interview subject. While he has a clear sense of his talent and importance, he’s more apt to discuss his personal relationship with God or how his lonely childhood as a latchkey kid inspired him to create rather than brag about how real he is. His power to articulate the struggle of urban youth — to explain the rage that motivates, say, ghost riding — is the very reason he’s often labeled the spokesperson for a hyphy movement otherwise devoted to "going dumb."

Hannity treated FAB like he’s dumb, but FAB turned the tables. Hannity’s denunciation of his effect on the "kids" prompted the rapper to question whether his influence rightly extends to a Canadian 11 years his senior, which Hannity countered by accusing FAB of wanting as much "money and controversy" as he can get. When FAB speculated on the influence of turning on the TV and seeing 3,000 soldiers die in Iraq, Alan Colmes was sent in as a balm, ending the segment.

"Both those people were adults," FAB says later of the ghost-riding deaths. "I feel bad for the families, but at the end of the day, an adult has to take responsibility for his actions."

GHOSTBUSTED


The next pothole for Yellow Bus was a late March cease and desist letter from Columbia Pictures for copyright infringement in the "Ghost Ride It" video — just as it was about to debut on MTV’s 106 and Park. "We had permission [to use the Ghostbusters van] from the man who built it and owns it," FAB explains. "But Columbia owns the logo." The video was immediately pulled from all media outlets, impairing Atlantic’s ability to market the single nationally. As a result, the Yellow Bus has been parked. The official explanation, from Atlantic VP Mike Carin, is that the label is focusing on FAB’s "artistic development." Despite the inevitable rumor that the rapper was dropped, Carin confirms that "the deal is still in place."

Still, such delays have silenced many MCs’ buzz: witness how the delay of Raekwon’s album on Aftermath has converted excitement into skepticism, or how the Team’s World Premiere (Moedoe/Koch, 2006) dropped too long after its singles had peaked, leading to lower-than-expected sales. Fortunately, the structure of FAB’s distribution deal allows him an unusual degree of freedom.

"They were willing to sacrifice certain things," he says of his initial decision to sign with Atlantic among competing offers. "They allowed me to do what I want to do — if I want to drop an independent album, I can."

ENTER DA BAYDESTRIAN


This flexibility has allowed the prolific FAB to immediately walk out another new album, Da Baydestrian, on May 15, through SMC/Fontana. Although, according to SMC cofounder Will Bronson, Atlantic has options to include as many as five of its songs on Yellow Bus, Baydestrian is an otherwise distinct project intended to satisfy the demand for a follow-up to Son of a Pimp. FAB’s also preparing a series of summer releases, including a second installment of the all-freestyle Tonite Show with DJ Fresh. (Fresh, incidentally, edited FAB’s 2005 DVD, The Freestyle King, now packaged with Baydestrian as a bonus.) With Beeda Weeda and J-Stalin, representing the East and West respectively, FAB’s formed the multihood group N.E.W. Oakland, whose mixtape is nearing completion. Prince of Da Bay (In Yo Face/Hooker Boy Filmz), a documentary on FAB by local hip-hop director Dame Hooker, should be out by press time, while FAB’s next DVD, Shoobalaboobie TV, is in the works.

"You do what you have to do to keep the buzz going," FAB says. "Also sales — on the independent level, your numbers are what’s important [to major labels]." Da Baydestrian thus has Atlantic’s blessing, but its commercial success will determine the fate of his deal.

Yet the need to appeal to the marketplace hasn’t inhibited FAB’s creativity, and Da Baydestrian refuses to play it safe. Rather than exploit the hyphy sound he helped establish, FAB only sprinkles it in, most obviously on the remix of the Traxamillion-produced "Sideshow" and the opening title track, one of six bangers produced by FAB protégé Rob-E. The young Martinez-born producer proves his versatility on tracks like the triumphant "Get This Together" and the melancholy "Life on Track," featuring Faeva Afta vocalist J-Nash, whose Hyphy Love drops in August. Another four productions by Son of a Pimp collaborator Genessee contribute to Baydestrian‘s in-house feel even as the family breaks new ground: "Can’t Wait," say, evokes Andre 3000’s explorations of go-go, filtered through FAB’s hyphy sensibility, while "Shorty Tryin’ 2 Get By" is a contemporary "Keep Ya Head Up" spiced with Bay Area R&B. The album is refreshingly free of skits, and guest stars are kept to a minimum, but Too $hort blesses the disc three times, an unambiguous stamp of approval from Bay rap’s founder.

What makes Da Baydestrian one of the most extraordinary albums since hyphy’s inception, however, is its social consciousness. "Deepest Thoughts," for example, hits out at President George W. Bush, but even more pointedly at Gov. Arnold Schwarzenegger for expanding the prison system instead of aiding the poor. The Sean T–produced "Crack Baby Anthem" addresses teen dope dealers, seeking to uplift without castigating or glorifying their activities — for the nonghetto audience, the song connects the dots between poverty, crime, and the present political climate. FAB describes his approach as "hip-hyphy," presenting an alternative to hip-hop fans who consider hyphy juvenile or incomprehensible. Granted, the disc’s school bus and helmet imagery — referring to the hyphy concept of acting "retarded" — is hardly p.c. Nonetheless, FAB’s lunchbox-wielding Baydestrian is a welcome change from the exaltation of guns and dope adorning your average rap album.

"In no way am I trying to say I’m like Martin Luther King or Malcolm X," FAB explains. "But I realized I could create nonsense and seem to support ignorance, or I can get people to start looking at the reality of it, and the reality of it is that young blacks are dying, not only in the Bay; they’re dying everywhere. We’ve been raised in a warlike civilization. We’ve been brainwashed to accept war as the proper thing to do when things don’t go right."

"Tupac [Shakur] said it himself," FAB concludes. "He said, ‘I’m not going to be the one to change the world. But I guarantee I’ll plant a seed in the mind of someone who does.’ We’re all the Tupac generation. Pac was hyphy."

While I don’t think it’s my place to declare FAB the next Tupac, I can’t fail to be struck by his invocation of the Bay Area icon. On a superficial level, of course, with all his non-thugged-out, cartoonish imagery, FAB is nothing like Pac, just as the hyphy movement differs from the Bay’s mid-’90s sound. Yet locally, if not nationally, the two rappers occupy the same position on the map of hip-hop: like Pac, FAB has cred with nearly everyone, he has a positive message within an utterly street aesthetic, and he makes tunes everyone wants to hear. No rapper has embodied all three attributes since Pac, and that combination makes FAB extraordinary. *

Newsom’s huge housing failure

EDITORIAL The single biggest issue facing San Francisco today is affordable housing. Nothing else even comes close. Housing costs are displacing, at a rapid pace, the people who make San Francisco such a great city — artists, writers, musicians, small-business owners and employees, families with kids, blue-collar workers, municipal workers, service-sector workers … basically, anyone who isn’t rich. And the vast majority of the new housing that’s getting built is selling at such high prices that it does nothing to help the situation.

That’s why it was crazy for Mayor Gavin Newsom to refuse to sign a modest $28 million affordable-housing allocation — and why the supervisors need to pursue this, push back, demand that the money be spent, and make it clear that Newsom’s budget proposals will be in trouble if it isn’t.

And this veto ought to be a huge issue in the mayor’s race.

It’s also why progressives need to start thinking big about how to address the housing crisis.

Let’s start with a simple fact: Newsom has done next to nothing for affordable housing in this city. All the important initiatives have come out of the Board of Supervisors and the nonprofits. He’s been willing to let private for-profit developers get away with giving the city only a pittance of affordable units in exchange for immensely valuable project approvals; only because the supervisors forced the issue has the city increased the inclusionary housing requirement. And it’s still way too little.

In fact, linking all affordable-housing money to market-rate projects is a losing game for San Francisco. Even if the city forced developers to make half of their new units affordable, that wouldn’t meet the current need as laid out in the city’s own documents. San Francisco’s General Plan states that two-thirds of all new housing built in this town needs to be below market rate.

Every time the city approves a major new project that’s (at best) 20 percent affordable, that ratio gets worse. If city officials keep approving projects with small set-asides, the city will continue to get richer, whiter, and more boring; the end game — a city population inching close to 80 percent millionaires — isn’t something anyone should consider acceptable.

The allocation Sup. Chris Daly proposed wouldn’t put more than a dent in the problem. But it would be money coming from the city’s General Fund, not money tied to more luxury condos — and that’s an important step. It reflects how the city needs to be thinking over the next few years.

Redevelopment money has funded affordable housing in the past, but much of that will run out soon. Finding other sources for the hundreds of millions of dollars San Francisco needs every year to even begin to keep pace with the need has to be a top priority — and Newsom and his opponent (and we’re convinced there has to be and will be a serious opponent) need to tell us where that money’s going to come from.

Meanwhile, San Francisco activists need to start looking at long-term planning priorities for housing that include some tight limits on how many new market-rate units can be built. Combining a cap on luxury condos and a new source of affordable-housing money can change the entire development equation in San Francisco.

And if Newsom won’t go along, then the supervisors need to make very clear that his budget is dead on arrival. *

Digital Venuses

Call them the new British bitch pack: barefoot soul shouter Joss Stone and her ascendant sistren, skankin’ Lily Allen and torchy Amy Winehouse (Corinne Bailey Rae’s exempted due to being a queen of nice and hazy sentiment and, well, yes, color). The Pipettes also deliver Ronettes-Supremes paeans but have yet to splash large beyond the UK. It’s Stone and Winehouse who have made recent history on the US pop charts: the latter’s Back to Black (Republic) scored the highest ever debut for a British woman (number seven), and Stone’s Introducing Joss Stone (Virgin) followed a week later, debuting at number two.

The third release in this triumvirate, Allen’s Alright, Still (Capitol), is the least compelling, though it possesses the most diverse sonic palette: ska, Britpop jangle, punk, rocksteady, N’Awlinz funk, and English dancehall, courtesy of her fellow celebutot music maker, DJ and producer Mark Ronson. While "Friend of Mine" will doubtless prove a decent summer jam, the scattershot production speaks more to Ronson’s patented retro-soul ambition than to individuality on Allen’s part. I’m already over the stunt sampling of Professor Longhair and find Allen’s spin on jaded indie affect and lyrics powered by class snobbery grating.

The aforementioned artists are part of yet another wave of British acts working in black American musical idioms: James Hunter, James Morrison, Lady Sovereign, and Alice Russell. Call them the spawn of Dusty Springfield. Blue-eyed British soul diva Springfield’s 1969 classic Dusty in Memphis (Rhino/WEA) is the obvious grail for most of these new acolytes. They’ve also benefited from the successive layers of space opened by Blighty’s trends in Northern soul, acid jazz, trip-hop, and the Yankee stand taken for retro soul by the now-defunct Desco label (which split into Soul Fire and Daptone) with black vocalists such as Lee Fields. One wants to big up Allen, Winehouse, and Stone on the sisterhood empowerment tip for their brassy attitude and scathing kiss-offs to trifling men on these recordings. And it’s interesting that they’ve emerged at a time when their male counterparts, such as Morrison — and David Gray and Chris Martin — seem to have "bitched up." Yet this gender power–reversal is sadly trumped by glaring issues of race and authenticity.

REAL ME, REAL MIMICRY


Nowhere are these issues more clearly embodied than in Joss Stone, who’s about to hit the Yay Area. She’s been around for a minute, leading the cited alien invasion with her Miami Sound–assisted debut, The Soul Sessions (Virgin), in 2003. Missed in all the hype and scandal over Stone’s breakup with Motown scion Beau Dozier, her recent adoption of a faux-Yank accent, and the sacking of her handlers is the fact that her much-vaunted revamp has a precedent: Stone described her second CD — Mind, Body, and Soul (Virgin) — as her "real debut," and it contained a mix of Southern soul, urban swing, and hip-hop similar to the template codified by Lauryn Hill in the late 1990s.

The 19-year-old blond Venus actually coaxed Hill out of her fog to guest on "Music," but overall Introducing merely treads water instead of shifting any postmillennial soul paradigm. Stone remains trapped by the novelty factor of having been a 15-year-old girl from Devon who could mimic a middle-aged black American singer and has not figured out how to reconcile her West Country roots, accent, and affluence with the grit and honesty her ambitions require. She’s content to let producer Raphael Saadiq locate her brand-new thang somewhere between Aretha Franklin circa Sparkle and the early ’80s Isleys, with a soupçon of hip-hop flourishes — an approach that only really sparks on opener "Girl They Won’t Believe It" — when underage Stone really ought to be ashamed at her affair with 41-year-old Saadiq. The specter of Dallas Austin’s banging for beats screed rears its ugly head.

Stone may be styled in psychedelic body paint, flowers, and baubles as some lost wild child of Janis Joplin, but unlike that late bad-Jewish-girl-with-a-yen-for-the-blues icon, she lacks the ovaries and independence to instigate any sonic revolt, nor does she transcend her black influences. Although she too failed to flip the rock biz’s race politics, Joplin was an original. She was also perfecting a worthy form of hybridity, whereas Stone would still do best to apprentice behind a seasoned soul singer and grow into her voice. Meanwhile, she’s an immature artist trapped within the middle-class mythos and mass fantasies of the pop star system.

RUNNING THE RACE?


White artists’ love and theft of black expression, as ratified by the Elvis phenomenon, remains the primary cultural battleground in the aughties — don’t get it twisted. The phenomenon of white singers who sound black is as old as minstrelsy, of course. Vaginas trouble this aesthetic guerrilla warfare — with Stone and company entrenched in the valley of sound between Joplin, Springfield, Lydia Pense, and Teena Marie on the one side and Madonna, Taylor Dayne, Britney Spears, and Fergie on the other. Yet Stone and her sister purveyors of femme funk are not truly innocents with songs in their hearts and stars in their eyes. These daughters of Al Jolson, removing their Jewish foreignness by sonically and visually blacking up as he did in The Jazz Singer, are reaping the rewards this season from the West’s most vital industry: the consumption and export of essential blackness.

Whether fucking or channeling the likes of Dinah Washington and Ronnie Spector in the studio, Allen, Stone, and Winehouse are enjoying everything but the burden of blackness. These vocalists face the dilemma of the privileges of whiteness versus the comforts of being soulful, and this will continue to dog their careers if longevity’s next. Doubtless Stone, Allen, and Winehouse don’t want to be "nappy-headed hos" — thanks, Don Imus — but desire the erotic, exotic power of sistagirls without being the mules of the world. Yet why is the old "black joy, not black pain" truism surfacing now in the UK?

Look to recent cinema from across the pond: in The Queen, Elizabeth II, the paragon of English womanhood, is asked by Tony Blair to be feely and emotional to help heal the nation in the wake of Princess Diana’s death, to restore the heart Diana represented. But Elizabeth chafes, bound by old royal models of honor and duty. The crisis of Britannia is coded even more explicitly in Children of Men. In its dystopic vision, black women are despised yet also figures of salvation. As in the film, in which only a regenerative black female can save England, these new wave British soulsters labor to recuperate the distant and unreal of classic soul, despite its distinctly American set of societal preconditions. A post–Margaret Thatcher, post-Blair return to authenticity is what these singers represent, a late moment after Rod Stewart delivered fair Albion’s best-ever approximation of soul and empire has faded, leaving postcolonial turmoil and identity flux. Black female soul brings rebirth to this turbulent world via the vocalizing of Stone et al., placing them back at center of the world — at least aesthetically.

FLIPPING BACK TO BLACK


This activity meets its zenith in the petite, pinup-tatted, beehive-burdened, anorexic form of Winehouse. Unlike Stone, who’s at pains to elide her Englishness, Winehouse’s distinctly North London Jewish accent surfaces on her critically acclaimed Back to Black, but her extreme jazz-soul mummery remains paramount, even as white critics and listeners continue to adopt a white version of black culture at the expense of young black artists of the retro-nuevo soul or urban alternative persuasion. Winehouse has yet to be anointed with a universal ghetto pass and, like Stone and Allen, has bypassed the hood and proper apprenticeship for lucrative prime time at the nation’s premier venues this spring.

Throughout Back to Black, Winehouse gets away with borderline minstrelsy, carelessly mashing up a vocal cocktail of Washington, Billie Holiday, Carla Thomas, and Phil Spector’s girl-group surrogates while not being excoriated because her Pete Doherty–rivaling tabloid exploits with drunkenness, raunchy sexuality, and public belligerence fit her admirers’ view of authentic blackness. Behind Spanish Harlem drag, Motown cocktail dresses, and Cleopatra’s black eyeliner, Winehouse is the cunning poster girl of her mid-Atlantic milieu, permitted to get away with potentially offensive lyrics such as "side from Sammy you’re my best black Jew" ("Me and Mr. Jones"), showcasing a pair of cooning black backing vocalists and hipster-comforting insincerity.

"What kind of fuckery is this?" I’m sure to Winehouse’s equivalents across the color line — from fiftysomething Sharon Jones to 36-year-old failing freaky-deak diva Macy Gray and badass bitches in the wings such as Alice Smith — it seems like the demoralizing same old. These are black artists who, to varying degrees, can sang but whose efforts render them invisible in a field overwhelmed by white soul saviors. Why invest in these sistas’ development or even spotlight the neo–chitlin circuit movement afoot in the Southeast when the only blackness that really counts bears a stench of formaldehyde? *

The promise of high-speed rail

EDITORIAL Imagine — there’s a project on the drawing board in Sacramento that would:

Get two million cars off California’s roads.

Eliminate any need for expensive and environmentally damaging new runways at the San Francisco International Airport.

Create tens of thousands of high-paying jobs for economically depressed Central Valley communities.

Generate untold billions of dollars in long-term economic development in the state.

Make the ugly trip from San Francisco to Los Angeles a simple and affordable pleasure.

Represent the single most important contribution California could make to cutting global warming.

Pay for itself in 10 years.

Why isn’t everyone in the state demanding that it go forward immediately?

That’s the strange question about high-speed rail. It makes perfect sense on every level. It’s the sort of project that ought to satisfy every interest group in the state. The environmentalists love it; so does the San Francisco Chamber of Commerce.

Yet Governor Arnold Schwarzenegger is prepared to effectively defund the agency that is planning the project, the California High-Speed Rail Authority, and is moving to ensure that the first installment of the money the project needs won’t be in the next set of infrastructure bonds, on the 2008 ballot.

The governor’s position is baffling, and the only explanations his staffers have offered are so factually inaccurate that they’re laughable. The Democratic Party supports it — but this project needs more than just a few statements of support. It needs to become such a priority for the state that the legislature can force the governor to move forward on it.

A high-speed rail line would carry people from downtown San Francisco to downtown LA in a little more than two hours. At current estimates, the trip would cost about $40. The technology is proven; high-speed rail works all over the world. In terms of energy use, it’s about the most efficient and environmentally sound way of moving people around that exists. The demand is clearly there. The total price tag — about $40 billion for a full build-out from Sacramento to San Diego — isn’t cheap, but every estimate shows that the project will pay for itself a decade after the first trains start running. That’s a great deal, even a spectacular deal, for any public works project.

But time is of the essence. Every year of delay hikes the price of the project by $2 billion. The high-speed rail agency ought to be racing at full throttle to get a plan on the next possible ballot — but instead, the governor’s budget is giving the authority less than a tenth of what it needs to keep going.

The nonpartisan legislative analyst says in a recent report that if the governor won’t fund the high-speed rail authority this year, the legislature might as well shut it down.

This is utter insanity. High-speed rail is crucial to the state’s future and needs a lot more champions. Don Perata, the senate president, and Fabian Núñez, the assembly speaker, need to tell the governor in no uncertain terms that the high-speed rail agency must be funded, and the first installment of bonds must be on the November 2008 ballot.

The Chronicle applies their “be fair to PG&E” news principle to a major study on the beneficial impact of small business in San Francisco

The article Local merchants reinvest in city, I pointed out, reported on a major $l5,000 study that was specially commissioned by the San Francisco Locally Owned Merchants Alliance and provided valuable ammunition to independents in their endless battle with the chain stores. The group made the study available exclusively to the Chronicle in hopes that the paper would do a major story, play it up, and give the small business community a much needed boost to a large number of readers.

Instead, I noted, the Chronicle, owned by the Hearst chain out of New York and a champion of big business and big development and big chains, gave the story its patented “let’s be fair to PG@E” approach or in this case “let’s be fair to the chains.” The Chronicle buried the story in its prime burial spot at the bottom of the right hand page of the business section where it buries stories it doesn’t like: for example, the Reilly story on his settlement with the Hearst and Singleton chains, which we called a Reilly victory (see Guardian coverage and other blogs.)
I held up the page and noted that AMD and the Gap and IBM all got the big heads above the fold.
And the small business story got the “let’s be fair to PG&E approach” with a much smaller head below the fold, “Local merchants reinvest in city, their study says.” Then, right there in the subhead was the clinker right out of the PG&E/big chain playbook that read, “Retail federation spokesman skeptical of survey’s claims,” buttressed further down in the story with some nice counter quotes, and a telling phrase that, gosh, golly, gee, those tricky merchants out there in the neighborhoods “acknowledged they see the study as a competitive weapon.” Wow! Pow! Wow!

Ellis Act crisis

OPINION Between 2004 and 2005, Chetcuti and Associates, a Walnut Creek real estate development company, bought eight Mission District apartment buildings. Within the first few weeks of ownership, the company served all the tenants in four buildings with Ellis Act eviction notices. In the next two months, three of the other buildings were Ellised. The company held on to the eighth building for a year before it gave those tenants Ellis notices.

The same is true throughout the city: John Hickey Brokerage, another out-of-town real estate company, gave Lola McKay (who died in 2000 while fighting her Ellis eviction) a notice within weeks after buying the building and then did the same to tenants in a North Beach apartment building – evicting those tenants just five days after a purchase deal closed.

In fact, more than half of all Ellis Act evictions in San Francisco are done by real estate speculators who have owned their buildings for less than six months. Almost one quarter are done by speculators who have owned the building for less than a month (and many of those are done in the first hours or days of ownership).

The buildings are then often sold as tenancies in common – essentially, as condos for people much wealthier than the ones who were evicted.

Rampant real estate speculation is bad enough on its own. What makes it worse is that this pattern is also an abuse of everything the Ellis Act was intended to be: a way for long-term landlords to be able to get out of the rental business and retire. When the Ellis Act was passed in 1985, its proponents said its purpose was to allow a landlord "to go out of business when he or she is convinced that they are no longer willing to devote the time, accept the frustration, expose themselves to the liability and other factors of continuing to be a landlord."

Apparently, companies such as Chetcuti and Associates and John Hickey Brokerage decided within days and weeks that they just couldn’t devote the time to or accept the frustration of being a landlord anymore and were compelled to evict the tenants. And that’s the case for hundreds of other real estate investors, many of whom are getting tired of being landlords within days of buying rental property.

Senate Bill 464 – which the State Senate will vote on any day now – would rectify this abuse and return the Ellis Act to its original intent. This bill simply says that a landlord must own property for at least five years before using the Ellis Act to evict tenants. It’s simple and fair, and it hurts only real estate speculators.

The vote is expected to be close – and unbelievably, the bill may not pass because a senator from San Francisco, Leland Yee, has indicated he may oppose it. No other city in California has been hit harder by the Ellis Act than San Francisco – yet our very own senator may kill this bill.

Thousands of residents here have been evicted under the Ellis Act, most of them senior or disabled. Ellis evictions are a crisis in San Francisco and are destroying lives and neighborhoods and communities.

Beyond the Reilly settlement

Shortly before Clint Reilly began a press conference April 25 announcing that he’d settled his federal antitrust suit against the Bay Area’s two largest newspaper companies, Cheryl Hurd of NBC affiliate KNTV, channel 11, loudly complained to the pack of reporters that she just didn’t quite get the story.

"Why does anybody care about this?" she asked, sounding annoyed as she waved the press release listing the terms of the settlement in the air. "I don’t even understand any of this. What’s this mean?"

She wasn’t the only confused reporter. In the week since the settlement was announced, the local media have downplayed or mangled what is actually a huge story: Reilly, acting on his own, with no support from federal or state regulators, managed to scuttle a deal that would have ended all newspaper competition in the Bay Area.

"Would I have liked to see it go further? Yeah," said Bruce Cain, director of UC Berkeley’s Institute of Governmental Studies, who penned a declaration supporting Reilly’s case. "But at least he was able to stop more collaboration between those two companies, and he was able to establish the legal point that this has more than just economic consequences. It has consequences for the vitality of political news coverage in the Bay Area."

The settlement involved a lot of peripheral terms, but the essence was this: the Hearst Corp., which owns the San Francisco Chronicle, can no longer consider combining printing, distribution, and ad sales with MediaNews Group, which owns almost every other major local daily in the Bay Area.

Reilly announced that the deal prevents the supposed competitors from unfairly or illegally negotiating any major joint operating arrangement in the near future. The trial was scheduled to begin just days after the agreement was reached.

"Newspapers are the intellectual bridge between citizens and their government," Reilly told reporters. "To me, one Bay Area newspaper company owning every paid circulation daily newspaper would be a very bad thing for Bay Area newspaper readers and for public discourse."

The deal nixes a plan outlined in a letter unearthed during an early phase of the trial. The letter showed that Hearst and MediaNews wanted to consolidate distribution and advertising operations among their local papers to create additional revenue and save on expenses.

Hearst enabled MediaNews to complete the purchase of several major local dailies last year by investing $300 million in the company’s stock. To survive antitrust scrutiny, the deal was crafted to make the stock’s value hinge entirely on non-Bay Area assets. But documents revealed during the suit clearly show that Hearst had planned to convert the stock so that it included MediaNews papers here as well. The settlement also prevents that from happening.

According to the terms, Reilly will recommend private citizens for appointment to the editorial boards of every California Newspapers Partnership publication in the region, including the San Jose Mercury News, the Contra Costa Times, and the Oakland Tribune.

He will also get access to advertising space in the pages of the papers for a regular column.

Reilly had originally sought to force MediaNews to divest itself of the San Jose Mercury News and other papers, but that was a long shot at best. What’s remarkable is that he accomplished as much as he did when no government agency was willing to help.

"I see in a lot of places what’s happening is owners are trying to make as much money as possible," Cain told us. "I see this in local TV, I see this in print media. I’m sure there’s an element of survival sometimes, but I think a lot of it is just trying to get profit margins up."

The US Justice Department never made a serious effort to stop the deal. The Guardian recently confirmed that the state Attorney General’s Office under the newly elected Jerry Brown has dropped its probe into the transactions. Spokesperson David Kravets refused to explain why.

The state’s treasurer and former AG, Bill Lockyer, began the investigation, and when we asked for a comment on Brown’s decision, he declined, saying he had "moved on."

Gina Talamona, spokesperson for the federal Justice Department, said its examination of Hearst’s substantial investment in MediaNews continues. But MediaNews CEO Dean Singleton told us that he expects it will not only close soon but will also clear the companies to move ahead.

Singleton said his meetings with Reilly, a Bay Area native and former mayoral candidate, were civil and there were no terms of the settlement he was displeased with. But he still doesn’t believe Reilly had grounds to bring the suit.

"A lot of wild statements have been thrown out that are simply not true," Singleton said. "There’s no evidence whatsoever that we had any discussions with Hearst about doing anything with the Chronicle that would have been improper. In fact, we’ve had few discussions about anything with the Chronicle."

Perhaps there was nothing "improper" as far as justice officials were concerned. But a March 2006 letter from Hearst vice president James Asher to MediaNews president Joseph Lodovic that surfaced during the case shows Hearst required an agreement on consolidated distribution networks with MediaNews before the company would proceed with its side of the transaction.

So let’s go back to Hurd’s question: why should anyone care about newspaper mergers in an era when there are so many other sources of information?

John McManus is a part-time journalism professor at San Jose State University and director of GradeTheNews.org, a consumer Web site on Bay Area news quality. He was hired as a consultant by Clint Reilly’s legal team to provide analysis of how consolidated or noncompetitive media outlets might fail to provide the best, most valuable news stories possible to local consumers.

His answer is simple. "Everyone is affected by the quality of newspapers because they form the bottom of the food chain for news," McManus told us. "Probably about 85 percent of the original news reporting in the Bay Area comes from newspapers, because they have much larger staffs than television stations or radio stations or Web-only operations."

McManus did his Stanford PhD dissertation in 1987 on four television news stations scattered around California, spending a month at each of them. At one of the stations, he said, what appeared in the local newspaper was so important, a station producer would clip stories directly from it and attach them to the assignments reporters were expected to have prepared by that evening’s newscast.

"The situation has gotten worse since then," McManus told us, "because local TV news staffs have shrunk."

The settlement also did not include an agreement on what would happen to the mountain of records produced in the case leading up to the trial.

Hundreds of pages previously sealed by the newspaper companies were opened to the public after the Guardian and the East Bay nonprofit Media Alliance intervened in the case. Reilly’s lawyer, Joe Alioto, recently insisted that he would petition the judge to unveil more documents, such as full depositions of company executives and additional memos and e-mails.

The settlement comes with some caveats for critics of consolidation. McManus believes that Reilly ultimately "got a quarter of the loaf." Reilly, he said, may have protected the independence of the Chronicle, but MediaNews isn’t being forced to unload any of its Bay Area properties to balance the field.

"Without [Reilly] having liberated the Mercury News and the Contra Costa Times and the smaller papers from the grip of MediaNews," McManus said, "the Chronicle‘s fate may be sealed." *

Editors note: The daily papers in the Bay Area treated the news of the settlement as a one-day story, and not a terribly big one. The San Francisco Chronicle ran it below the fold in the business section with a one-column head. But over the next few days, there were a lot of development and arguments over the deal; the trade journal Editor and Publisher was all over it. But none of that made it into the supposedly competitive local daily press.

So, the artists at Hunters Point Shipyard succeeded in getting their concerns mentioned in the “Conceptual Framework” for the Bayview Hunters Point redevelopment project, which is more than they had a week ago.
States the new improved draft, “The Project shall provide at affordable rates new or renovated permanent space at the Shipyard sufficient to accommodate the existing artists. The construction of the Project must be phased to ensure that the existing artists have the right to move to the new or renovated permanent space, without being displaced from the Shipyard. To achieve these objectives, the City, the Agency and the Primary Developer will work in consultation with the artists to create the plan for the permanent affordable facilities, including any relocation plan.”
Now, objectives aren’t quite the same as the end product. Experience suggests that the artists are gonna have to focus on a whole bunch of meetings if they’re going to have a prayer of keeping Building 101 and getting a Shipyard Center for the Arts, as they apparently would like.
Especially, if the 49ers dump San Francisco for Santa Clara as planned.
sure, Lennar’s conceptual framework also aims to “ensure the revitalization of the Project Site, comprised of Candlestick Point and Phase 2 of the Shipyard, and the generation of public benefits to the community and the City from development, even if the 49ers do not build a new stadium at the site.” But that doesn’t mean anyone, least of the artists, should take their eyes of the ball just yet, especially as the debate about an early transfer of the shipyard’s Parcel B, C, D, E and F is far from over. April has been an exceptionally busy month for the artists at the Hunters Point Shipyard. In addition to dusting off work spaces in preparation for the upcoming Spring Open Studio, the 300-member colony is scrambling to track the implications of Mayor Gavin Newsom’s ever-shifting effort to keep the 49ers in town, particularly as it affects the artists who have rented space at the base for 30 years.

Newsom’s latest proposal involves building a football stadium in the shipyard rather than at Candlestick Point. That’s likely to displace a group that claims to be the largest colony of artists in the nation – unless the mayor can find a place for them in his hasty plans.

"Hellzapoppin’" is how shipyard artist Marc Ellen Hamel described the recent flurry of redevelopment-related meetings. Newsom says he needs to fast-track the transfer of the shipyard from the Navy to the city if he is to meet the 49ers’ deadline for being in a new stadium by 2012.

The blitz was triggered by the 49ers’ announcement in December 2006 that they were considering a move to Santa Clara – which team officials in part blamed on Newsom’s inattention – leading some Bayview-Hunters Point residents to complain that they’re paying the price for the administration’s fumble. Newsom has proposed folding Candlestick Point and the shipyard into a giant 2,000-acre redevelopment project – to be managed by the Lennar Corp., whose profits are nose-diving and which is being sued for alleged whistle-blower retaliation in connection with its failure to control toxic asbestos dust at the site.

"Newsom’s latest plan confirms his critics’ worst fears that this is a bait and switch," said builder Brian O’Flynn, who was part of last year’s referendum drive to put the city’s previous Bayview-Hunters Point redevelopment plan on the ballot and this year’s lawsuit to force a vote. "This latest plan is about political coverage for the mayor in an election year."

His group, Defend BVHP Committee, was already concerned about Newsom’s role in thwarting a vote on the old plan and has even more concerns about the new plan. "If the 49ers leave and the stadium plan is off the table, then Newsom’s latest proposal will make way for more condos for Lennar," O’Flynn told the Guardian.

Matt Dorsey of the City Attorney’s Office said that regardless of whether the city was right to strike down the referendum – as he maintains state case law required – the new plan will get more scrutiny. The Board of Supervisors voted in February to support Newsom’s approach to the shipyard but stipulated that the terms of any such transfer "require approval by the Recreation and Park Commission, the Board of Supervisors, and such other possible approvals, including voter approval."

The artists’ colony is waiting to learn the specifics of Lennar’s redevelopment proposal, which talks of creating "permanent space for the artists at Hunters Point Shipyard," along with new waterfront parks, 8,500 units of housing, and job-generating development. So far, Michael Cohen of the Mayor’s Office and Lennar’s Kofi Bonner are only shopping around what they call a "conceptual framework," which vaguely describes the parameters for merging the yard and Candlestick Point.

The city has promised to replace all existing low-income housing at the Alice Griffith projects and to phase in new units carefully so as not to displace current residents. The artists have not received such promises. They don’t know if they’ll end up paying double the price for half the space they currently occupy, which amounts to 248,400 square feet, according to building 101 artist David Trachtenberg.

But with Lennar announcing a two-year planning goal and talking about an arts-themed development, the colony is formuutf8g its own ideas about how such a plan could work.

"The shipyard is almost like an artists’ retreat," Estelle Akamine told us, as five colleagues spoke passionately about the light, desolation, and poppies that attract artists to the base.

"But it didn’t always feel like a retreat," recalled Akamine, who has rented at the shipyard for 18 years. "There was a lot of trauma in the 1980s when we thought that the USS Missouri was going to be home-ported here. So we’re very skeptical of plans. We were born out of politics."

The Mayor’s Office claims the city is working to expedite the cleanup and transfer of the shipyard not only to adhere to the 49ers’ timeline but also to "allow us to move forward with community benefits like parks, affordable housing, and jobs for the Bayview." Trachtenberg believes the mayor has a strong interest in keeping artists at the yard too.

Newsom promotes his proposal as a way to create jobs and revitalize the BVHP economy. Akamine said, "Artists are the tip of the iceberg. We’re the visible part of a huge, largely hidden industry." Recalling how artists in SoMa fell victim to the dot-com boom at the end of the ’90s, Akamine hopes such displaced organizations will be able to relocate to the shipyard.

"Why can’t we have galleries and suppliers down here too?" she asked.

April Hankins, who rents a studio in building 117, wants to see "performance space for productions, community theater and music, and touring groups. We are discussing space for classes. Ideally, it could make San Francisco a destination for the arts."

Dimitri Kourouniotis, who rents in building 116, is stoic about the inconvenience he’s already endured, thanks to the Navy’s radiological remediation on Parcel B, where his studio is situated.

"We have already had to leave temporarily," said Kourouniotis, explaining how a three-week project to remove radiological contamination from sewers and pipes ended up taking five months and left six buildings without running water or plumbing.

Hamel, who’s rented a studio in building 101 for 15 years, wants people to know that there’s "nothing wrong" with the artists at the shipyard. "We’re not contaminated, and none of the artists have had problems with illness from possible toxic elements," she says, while Hankins compares artists to the athletes that Newsom is apparently scrambling so hard to keep.

"Both need an arena in which to exhibit increasing skill," Hankins says. "An artist’s work and an athlete’s performance is their gift to their audience. In showing patronage, ball games with high ticket prices are attended; art is collected. In communities and teams, both nourish the culture of the city for which they perform. It would be a great loss to the Bay Area to have the shipyard artist community become a redevelopment casualty." *

Small Business Awards 2007: Chain Store Alternative Award

Since it opened in 1954, Waldeck’s Office Supplies in downtown San Francisco has been a true neighborhood store. In spite of the growth of now-ubiquitous large chains such as Staples and OfficeMax, this family-run retailer has carved a niche with its host of regular local customers and businesses large and small in the neighborhood.

Of the supply shop started by his father, owner Cliff Waldeck says, "Neighborhood-serving retail businesses are why people live, work, and visit specific communities." For him, seeing regulars come in is the best part. "It’s like a scene out of Cheers."

Waldeck’s also leads its industry in being environmentally conscious. Two years ago it was certified as a green business by the San Francisco Department of the Environment.

As Waldeck, a former member of the Mill Valley City Council and a current member of the Bay Conservation and Development Commission, puts it, "I always like to say, ‘In my industry we’ve killed a lot of trees, and I have sap on my hands.’ "

Having done environmental work and advocacy as a public servant, Waldeck decided to make the transition to green practices. To get green certified, he had to demonstrate to inspectors from the San Francisco Public Utilities Commission and Public Health Department that he uses good environmental practices, abiding by criteria including recycling and reusing products, conserving energy and water, and maintaining a healthy office space.

The office supplies retailer also stocks green products such as recycled copy paper, greeting cards made of recycled paper, and energy-efficient items. And you can drop off your fluorescent tubes, toner cartridges, cell phones, and other electronics for free recycling.

Survival is a constant issue for a small business, particularly one downtown, where Waldeck’s competes for retail rental space alongside billion-dollar companies. Waldeck points out, "You might have formula retail legislation that helps preserve places like North Beach and Hayes Valley, but the Financial District doesn’t have that. I have five Starbucks within five blocks." With national chains creating the market rate for retail space, he adds, "it’s extremely difficult to make it just on your foot traffic of people coming in paying cash."

Believing that green practices and the success of a small business can go hand in hand, the retailer has an interesting proposition for San Francisco’s political leaders: anyone bidding on a city contract for goods or services should be required to name seven or so green-certified San Francisco entities they do business with, which would encourage huge companies to work with small, green-certified businesses. "What I’m advocating is that since the city and county of San Francisco is the largest employer and purchaser here, they can lead by example," Waldeck says. "Procurement in SF is basically a cage match now. Whoever wants to sell a product at the lowest price is the one who gets the contract."

With a stockpile of past awards, including the San Francisco Urban Solutions Neighborhood Business Award, San Francisco Small Business Network’s Green Business of the Year, and one from the Environmental Protection Agency Region Nine, Waldeck’s plans to keep up the good work. (Julie Park)

While watching Land use & Economic development committee meeting on SFGTV the other day, I caught a bit of public comment on the whole Healthy Saturday thing and had the thought: “Maybe this is more about providing public transportation to public places than it is about bicycles.”.1.jpg

At the meeting, parents said they couldn’t get to the museum for family programs, and museum staff complained about getting to work without being able to park on the street. The parking garage, at $3/hour, is cost prohibitive.

Nan Tucker McEvoy, granddaughter of museum founder M.H. de Young, spoke in opposition to closing JFK on Saturdays. “When my great grandfather gave the museum to the city, he gave it to all the people of the city, not just the ones who ride bicycles or can walk great distances,” she said

With Brian Wilson, the Roots, and Common performing and Amy Goodman and Ariana Huffington speaking, how can you miss it?

It’s a green-minded, art-and-music-focused campout in a forest wonderland. Organized by Los Angeles’s the Do Lab with participation from tons of SF artists, this three-day event is powered by alternative energy, offers ecoworkshops in everything from permaculture to raw foods, and encourages rideshares — including a participant-organized bus trip from San Francisco. Also featuring performances by Freq Nasty, Bassnectar, Vau de Vire Society, El Circo, and other DJs and artists from San Francisco and elsewhere, LIB attempts to change the precedent that festival fun has to be ecologically disastrous.

"Sierra Nevada World Music Festival" Mendocino County Fairgrounds, Boonville; www.snwmf.com. June 22-24, $125 plus $50 per car camping pass. Peace is green, right? I mean, what about Greenpeace? And peace is what this festival, which promotes "conscious" music, is all about. Plus, a range of representatives of environmental and social issues will be tabling at the festival — and registering voters.

"Burning Man" Black Rock City, Nev.; (415) TO-FLAME, www.burningman.com. Aug 27-Sept 3, $250-$280. With its Leave No Trace philosophy and its hippie roots, Burning Man has always been greener than most. But this year it’s getting even more explicitly so with the theme the Green Man, focusing on humanity’s relationship to nature (even though there is no nature on the dry lakebed surface). A pessimist might suggest this year’s theme is just another excuse to waste resources on leaf-themed art cars and that "Leave No Trace" usually translates to "Leave Your Trash in Reno." But an optimist might say this is Burning Man acknowledging and trying to address such issues. Either way, air out your dust-filled tent and pack some chartreuse body paint — it’s going to be an interesting year in Black Rock. *

Green city, part one: cut back cars

EDITORIAL San Francisco needs a real green city agenda — not something that comes out of Pacific Gas and Electric Co.’s corrupt propaganda operation or from the timid folks in the Mayor’s Office but a comprehensive environmental plan for the next 10 years that aims at making San Francisco the nation’s number one city for green policy.

There’s no point in thinking small: this is the year for dramatic talk about real environmental action. And it doesn’t have to be overwhelmed by global problems; there’s so much to be done right here at home.

We will be laying out a much longer, more detailed platform over the next few months, but here’s one way to start:

San Francisco ought to commit to cutting car use in the city by at least 50 percent in the next five years.

How do you do that? By making cars unnecessary and slightly more expensive.

The nation’s addiction to oil didn’t come by accident. As Thomas Friedman wrote in the April 15 New York Times, then-president Dwight Eisenhower responded to the cold war in part by building the Interstate Highway System, which allowed the military to move people and weapons quickly — but also set the nation on a path to the car-driven development and land use that are now poisoning the environment and global politics. Turning that around requires tremendous dedication and political leadership, but San Francisco shouldn’t have to wait for the rest of the country.

A citywide auto-reduction plan would involve sweeping land-use changes. Some streets, such as Market, should be closed to cars entirely. Much downtown parking should be eliminated. More bike lanes and transit-only roads, more pedestrian-friendly shopping areas, and other measures of that sort would not only help discourage car use but also make the city a more livable place.

But there’s more: a city that discourages car use has to build housing for local workers — that means affordable housing for the city’s service-industry and public-sector workforce. All new housing needs to be evaluated on that basis: will people who work in San Francisco be able to live here — and avoid long commutes? Most housing currently in the planning pipeline utterly fails that test.

To make cars irrelevant, public transportation has to be vastly improved. As Sups. Chris Daly and Aaron Peskin point out in the Opinion on page 7, that means better management. But more than anything, it means money — big money. Muni fares ought to be reduced dramatically (or eliminated altogether) — but in exchange, Muni needs a dedicated funding source. A special fee on downtown businesses makes sense. A citywide transit assessment on property owners might be necessary.

It’s not fair to place a burdensome tax on cars that makes it possible only for the rich to drive — but simply restoring in San Francisco the vehicle fee Gov. Arnold Schwarzenegger wiped out would cover Muni’s deficit. Assemblymember Mark Leno is working on this, and it should be a top civic priority. So should pushing high-speed rail (see page 19), which would eliminate tens of thousands of car trips between San Francisco and Los Angeles.

There are lots of ways to approach this goal; the supervisors and the mayor just need to set it and enforce it. *

saw fit to run a story on a key decision in favor of the Guardian motion to unseal the records during and after the Riley antitrust trial. Why people get mad at the media (l5)

Federal Judge Susan Illston’s latest decision was an important free press and public access victory and may lead to an unprecedented public examination of the Hearst/Singleton/Gannett/Stephens move to monopolize the press in the Bay Area and much of California, yet the chain papers and the Associated Press, their wire service, didn’t run the story.

Impertinent rhetorical questions: Why? Will they publish the story? Will they continue to fight to seal the documents despite the judge’s order? Will they continue their policy of promoting the publishers’ side and tossing a bone now and then to plaintiff Clint Reilly?

I think attentive readers of the Guardian and the Bruce blog have a pretty good idea. But, being objective and fair-minded on monopoly issues, I will pose the questions and see if I can get some answers:

To Hearst corporate in New York and MediaNews Group/Singleton corporate in Denver, and Gannett corporate in Arlington, Virginia, and Stephens in Las Vegas: Why didn’t you do the unsealing story? Will you? When? Will you continue to fight to seal the documents despite the judge’s unsealing order?

To the editors and publishers of the San Francisco Chronicle/Hearst, Oakland Tribune/Singleton, Contra Costa Times/Singleton, San Jose Mercury News/Singleton, San Mateo Times/Singleton, Independent Journal in Novato/Singleton: Why didn’t you do the unsealing story? Will you? When?

To the Associated Press: I called the AP office in San Francisco and found that the editor on the story was Brian Corovillano, but he was away from his desk. So I emailed him the questions. He later emailed me this note: “We covered Tuesday’s ruling and I’m attaching the story below (B3: Illston’s decision to allow the lawsuit to proceed.) We decided yesterday’s development didn’t rise to the level of another AP story. But we’ll certainly be keeping a close eye on developments in the caae as it continues.”

As expected, Federal Judge Susan Illston ruled on Tuesday April l0 that Clint Reilly can go to trial in his antitrust suit opposing the Hearst/Singleton deal to monopolize the Bay Area newspaper market.

The San Francisco Daily, a free daily, played the story the way it ought to be played: on the front page, with a strong head, “Newspaper monopoly trial allowed, Bid to block it quashed,” and a good lead that said, “A federal judge yesterday cleared the way for an unprecedented jury trial to determine if the consolidation of newspapers in the Bay Area violated antitrust laws.”

The Chronicle and the Singleton papers continued to run the story as if it were a rummy little squabble between a lone angry reader and a big company out there somewhere, without any redeeming journalistic or public interest values.
But the Chronicle did move the story from its usual burial spot in the business section to a new burial spot: straddling the fold on page 4 of its Bay Area section with yet another Rip Van Winkle sleeper head, “Judge permits trial over newspaper deals.”

The story is even harder to find on the Chronicle’s website. When I checked about 5:30 p.m. on Wednesday, It ranked 23rd on the list of Bay Area stories, behind Farley the cartoon strip, and behind such blazers as “Bay Bridge Labor Day closure may begin early” and “Rain, rain will go away–’til possibly Saturday” and “Out to pasture they go–3 police horses retire/Long in the tooth, these mounts head to Santa Rosa ranch” and “Muni breakdown creates delays.” However, it did rank ahead of “Miniature boats provide major fun.”

More: not only are the Galloping Conglomerati blacking out and mangling a major story involving their own papers,
but worse they are continuing to reverse their own historic free press and sunshine-in-the-courts positions. They are continuing to press the documents of secrecy, stonewalling, and collaboration in federal court to cover their
moves to monopoly.

Alas, Illston allowed the publishers to keep their records sealed, and the Reilly responses sealed, in their latest filings on April 6, despite her earlier order to open the court records on the demand of the Guardian and the Media Alliance. (The Guardian is appealing her decision and will continue to press to open up the records and keep them open throughout the trial, which is scheduled to begin on April 30.)

Too bad. You can tell, just by glancing at the extensive list of Reilly declarations and records that the publishers want to keep under seal, that there is a lot of explosive stuff in the hopper. Meanwhile, the Riley case remains the only major impediment to the Hearst/Singleton deal. And I am getting the impression that Riley is building a strong case and that Hearst and Singleton are getting extremely nervous about the outcome. It’s going to be a helluva trial.

Check the publishers’ filings below for a preview of coming attractions and the lengths to which they will go behalf of court secrecy and stonewalling. Check also the move by the Guardian attorneys, the First Amendment Project in Oakland, to request Illston to review her sealing order. Most important, check Illston’s excellent, well-reasoned order denying summary judgment. She nails the Hearst/Singleton position on point after point. B3

A law school of their own

In today’s "I’m gonna sue you" world, in which lawyers are called sharks (and often rightly so), getting a law degree from a school that offers the class "Education for a Just, Sacred and Sustainable World" might seem a little backward. However, since the ’70s a number of schools have been encouraging students to study law as a tool for practicing social advocacy — not just for lining corporate pockets (or their own).

One of the Bay Area’s banner examples is the New College of California, which — founded in 1975 out of the civil rights movement — has the oldest public interest law program in the country. But there are other stops for those with lawyerly aspirations. Golden Gate University not only offers certification in public interest law but also gives a number of incentives for students interested in helping local communities. UC Hastings College of the Law has the in-house Civil Justice Clinic, which gives students a chance to add an activist bent to their education. And most other nearby schools — from UC Berkeley’s School of Law to the University of San Francisco — now offer some kind of public interest law specialty.

So what are these programs like? Is this law lite?

Certainly not, Civil Justice Clinic director Mark Aaronson says. For example, clinic courses — which deal with employment law, housing law, and disability benefits among other areas of social interest — are very serious. In fact, students handle real cases and are advised by professional lawyers. As part of the course work in Aaronson’s Community Economic Development Clinic, students may survey community needs or translate court documents for neighborhood residents. The school is even more rigorous thanks to the fact that the yearlong program is limited to just eight students, giving them plenty of firsthand experience handling real-life legal situations. "Lawyers have to learn to lawyer in context, dealing with real problems as they occur — not just hypotheticals in a classroom," Aaronson says.

And UC Hastings’s dedication to this program goes beyond classes and course work. A number of student-led organizations offer a chance for community involvement: one group volunteers at outreach centers in SoMa along with UCSF medical students to provide medical care and legal advice to the underserved.

So where do graduates of these social justice law programs go? Some join private law firms, of course, or find government jobs serving communities in need. But others, such as Paul Hogarth, use their education to do something else entirely.

Hogarth is now the managing editor for BeyondChron.com, a daily news site produced by the Tenderloin Housing Clinic that tries to raise awareness about the Ellis Act and tenant housing rights. But first he attended Golden Gate University with help from its Public Interest Law Scholars Program, a scholarship fund that gives up to $15,000 in tuition aid and a $5,000 internship stipend to five students a year. He says the skills he gained at Golden Gate are integral to his job now.

"Sometimes I’ll write a story about a court case, and I’ll do a legal analysis of it," Hogarth says. "I also cover City Hall, and I can read legislation that’s going through and then say, ‘Well, this is what the law will do.’ "

Had Hogarth chosen to work for a nonprofit or as a public defender or prosecutor, he would’ve been eligible for a generous tuition repayment assistance grant from Golden Gate University.

It seems one of the greatest benefits of joining these programs, though, is being surrounded by like-minded people passionate about social change. For example, Antonia Jushasz, a teacher in the Activism and Social Change masters program at New College, spoke at a protest rally against the Iraqi Oil Law at Chevron Corp. headquarters March 19 with four of her students looking on — making up an impromptu class.

It’s not exactly what most of us think of when we imagine a law education. And graduates from these programs don’t exactly fit the stereotype of one of the world’s most hated professions. But it just proves as there’s more than one way to be a lawyer, there’s also more than one way to become one. So if you imagine your lawyer self as more of a dolphin (or an otter or maybe a sea lion) than a shark, don’t worry. There’s a place for you too. *

Why people get mad at the media (l3) The latest example of how Hearst and Singleton monopolize the news in the Reilly antitrust case

The Guardian and Media Alliance won a major victory in federal court to unseal the records in the Reilly vs. Hearst antitrust trial but it didn’t last long: Hearst and Singleton quickly went into overdrive to maintain their cloak of secrecy and monopolize the news in the latest round in court.

Here’s how they did it: The newspaper chains that are trying to kill daily competition and impose regional monopoly in the Bay Area tried to knock Reilly out of court by claiming in a specious argument for summary judgment that he was just a lone reader, poor soul, and thus did not have standing in court. Reilly and his attorney Joe Alioto are suing to block the Hearst/Singleton deal.

The San Francisco Chronicle story on the filing, by Bob Egelko, laid out the publishers’ case in detail with lots of quotes in a page 2 story in the Bay Area section. He didn’t report the Reilly side of the story because (a) he didn’t contact either Reilly or Alioto for comment and (b) Reilly’s legal response was under court seal and Federal Judge Susan Illston allowed them to stay under seal despite her earlier ruling to open.

The publishers, who usually are bellowing away about courts and government suppressing documents, submitted declarations in support of keeping the documents secret from Daniel S. Ehrman, vice president of planning and development for Gannett, and Joseph J. Lodovic, president of Singleton’s Media News Group.
And then, in virtually identical proposed orders to seal, they laid out the “compelling reasons to maintain the documents and excerpts of documents…under seal.”

So the Hearst/Singleton side of the story got published in their papers, not the Reilly side. And then on Saturday April 7 the Chronicle continued the publishers first coverage with a short story on the hearing the day before.
“Mr. Reilly’s injury here is pure speculation,” the Chronicle quoted Gary Halling, Singleton attorney, as saying.
The Reilly/Alioto comments were at the end of the story. The story reported that Illston was inclined to allow Reilly to sue as an individual, which is likely to be her ruling.

Hey, Citizen Reilly here is representing the public and he, as well as the rest of us, deserve to know the grisly details of how the barons got together and how they are dividing and clustering up the Bay Area newspaper market to their financial advantage and to the public’s disadvantage. So our attorneys, James Wheaton, David Greene, and Pondra Perkins of the First Amendment Project in Oakland, went back into court to reup their court victory and try to open up the records and maintain a public policy of sunshine in the courts.

The key journalistic and public policy point: not one iota of the Hearst/Singleton’s repeat move for secrecy was considered newsworthy by any of their papers. The first time around, as attentive Bruce blog readers will remember, they mangled the story, made it look as if the Guardian lost our motion to open the records, and we even had to ask the Associated Press, their wire service, for a correction.

P.S. The Hearst/Singleton reasons for secrecy and stonewalling are delicious, so delicious that tomorrow I will put them up on line for readers to savor in the original (I am a typewriter fugitive and need help on these things.)
A preview of coming attractions: the proposed order to seal the documents says, for example,
that “the court finds that the Subject Documents contain information that was not prepared not for public consumption but to analyze the proposed acquisition of the McClatchy newspapers and to negotiate a single equity investment by Hearst. these documents contain detailed non-public financial information about MediaNews and/or CNP (the special partnership arrangement), including valuations of certain company assets, projections for future earnings, pro forma financial information about the company’s current and future business plans. MediaNews and CNP do not publicly disclose information of this nature.”

Tough: if you want to monopolize an entire region, and seriously undercut the marketplace of ideas principle underlying the First Amendment the big boys love to quote, then you’d better be prepared to disclose these basic documents in court when you are sued in a public-spirited antitrust case.

P.S. Repeating for emphasis: Where is the U.S. attorney’s office, which was so quick to put Josh Wolf in jail and keep him there for 226 days, when the real lawbreakers in the publishing business are making monopoly millions by eliminating competition? And where is Atty. Gen. Jerry Brown, who lives in Oakland under the shadow Dean Singleton’s Oakland Tribune?
