The San Francisco Redevelopment Agency has endorsed a draft financing plan for Lennar’s massive proposed Hunters Point Shipyard/Candlestick Point development project, one that increases the company’s housing entitlements and profits.

The agency’s endorsement came during a hastily convened Oct. 27 special meeting, raising the eyebrows of Lennar’s critics. So did the details of the agency’s non-binding financial agreement with Lennar, which two citizens’ committees in the Bayview–Hunters Point community had jointly endorsed a week earlier.

Bayview–Hunters Point resident Francisco Da Costa claimed that "there was almost no public notice of the plan," while Leon Muhammad, who sits on the Bayview–Hunters Point Project Area Committee, fretted that some committee members have business ties and connections with Lennar.

"A group that supposedly represents the interests of the community needs to have transparency and full disclosure," stated Nation of Islam Rev. Christopher Muhammad, who has been a staunch critic of Lennar ever since the developer failed to properly monitor and control asbestos adjacent to his group’s K-12 University of Islam school.

"Lennar never intended to do anything with this land but bank it," Muhammad opined about the public land that Lennar is getting for free. "And now they are hoping to squeeze more profit out of the deal, so they can hedge to where they can make it more attractive to sell."

Alicia Schwartz of People Organized to Win Employment Rights (POWER) observed that the deal is likely being driven by Mayor Gavin Newsom’s unrequited desire to see the Olympics come to San Francisco — a dream that was squashed two years ago, Schwartz recalls, "amid a hoopla around toxicity at the shipyard."

Sup. Chris Daly, who has argued that Lennar’s recent $500,000 settlement with the Bay Area Air Quality Management District over Lennar’s asbestos violations was "too small and poorly handled," said he wasn’t surprised by the latest deal: "That Lennar wants to pull a fast one is not news."

But with the financing deal likely headed for the full Board of Supervisors this month, Lennar’s critics are worried that the city is being rushed into a deal that has already changed since voters approved Proposition G in June, supporting the vague outlines of Lennar’s project.

They note that while Prop. G specified that the project would create "between 8,500 and 10,000 homes" in the depressed southeast sector, the financing deal that Redevelopment endorsed last week specifies 10,500 homes —and a demand that the agency and the city cooperate to help increase Lennar’s annual rate of return.

Stephen Maduli-Williams, the agency’s deputy executive director, told the Guardian that it was always the agency’s intention to finalize Lennar’s draft financing plan by the end of 2008. Asked if Lennar increased the number of proposed housing units by reducing unit size or increasing building height, Maduli-Williams told us, "They did it by finding a way to squeeze more units into the existing space. They redesigned one of the roads."

"Things are probably going to change again in the next year or two," Maduli-Williams said. "This is a living document. And overall, it is a really nice real estate deal."

Yet critics of Lennar are openly wondering whether it’s nice for the beleaguered company, which had rapidly plummeting stock value even before the recent real estate meltdown, or nice for the city. Maduli-Williams said the deal works for all parties.

"We have strong financial partners," he said. "Any investors that look at the deal know that is it really solid. It includes mostly $600,000 homes, which are cheap by San Francisco standards. And we are not looking to break ground for another three years, by which time the economy, hopefully, will be in good shape."

Maduli-Williams also observed that despite nationwide housing woes, San Francisco remains "one of two or three top destination spots where there is only so much land left and where folks have very high incomes."

But the health of the San Francisco real estate market (compared to the rest of the nation) combined with Lennar’s ongoing financial woes, including a June 8 bankruptcy at Mare Island, is precisely why some folks are questioning Lennar’s increased profit demands. But Maduli-Williams said, "San Francisco cannot be compared to Mare Island."

According to the draft financing deal (which is non-binding), Lennar, the city, and the agency "will work cooperatively to reduce risks and uncertainties" and "find additional efficiencies and values," to achieve Lennar’s proposed 22.5 percent annual profit margin.

As Maduli-Williams explained, if the developer puts up $800 million in equity and wants a 22 percent return, it would have to get $1.2 billion in land sales. "And just like any developer, they want to get the highest return possible," he said, adding that the project’s proposed community benefits are "hard wired into the deal" and thus are "not threatened" by Lennar’s proposed target return increase.

Lennar’s proposal, which represents a 7.5 percent increase over current project projections, has also received validation from CBRE Consulting, which is a subsidiary of CB Richard Ellis — a global real estate firm headed by Sen. Dianne Feinstein’s husband, Richard Blum.

In an Oct. 15, 2008 memo (coincidentally written the day President Bush announced a partial nationalization of the US banking system) to Michael Cohen, who heads the Mayor’s Office of Economic and Workforce Development, CBRE’s Mary Smitheram-Sheldon and Thomas Jirovsky observed that, "Based on Consultants’ extensive experience in evaluating large scale mixed-use developments, including military base reuse plans, we are of the opinion that the proposed 22.5 percent per annum target return …is reasonable."

Earlier this year, as Lennar spent $5 million to support Prop. G, CBRE declared that 50 percent affordability in Lennar’s proposed mixed-use development at the shipyard, as was being recommended in Daly’s Prop. F, was "not financially feasible."

At the city’s request, CBRE analyzed Prop. F and concluded in a memo to Cohen that it would reduce Lennar’s revenue by at least $1.1 billion. Reached by phone this week, Jivorsky acknowledged that his firm has done work for different developers around the country for years, including Lennar.

"But we are not working on anything for Lennar in San Francisco," Jivorsky told the Guardian. "Our client is the city of San Francisco and we take our job very seriously. We would never make recommendations that we didn’t believe were in the city’s best interests."

Meanwhile, Cohen told the Guardian that the strain for real estate capital is likely going to push the rate of return demand up even more. Noting that the city agreed to 25 percent returns at Lennar’s previous Treasure Island and Hunters Point Shipyard deals, Cohen said, "Real estate is considered to be a greater risk than it was six months ago, even in San Francisco. So, it’s not so much that we have to negotiate this as have to understand what is required for private capital to invest."

Cohen believes that when the construction plans — which currently have few details spelled out — get more detailed, they will help increase the project’s rate of return. "Which is why," Cohen added, "the developer’s partners are willing to spend a boatload of money."

On Aug. 19, the Redevelopment Agency approved the addition of Kimco Developers and MACTEC Development Corporation as Lennar BVHP’s retail and infrastructure partners, and Scala Real Estate Partners, Hillwood Development, and Estein Associates USA Ltd. as Lennar BVHP’s equity partners.

Cohen also hopes that the 49ers’ intentions towards San Francisco will be resolved by November 2009, when Lennar hopes to enter into an agreement with the football team. The 49ers continue to pursue plans to relocate to Santa Clara, and have not signaled any desire to remain here.

To date, Lennar’s draft financing plan includes an agreement that the developer will contribute $100 million in cash toward construction of a new 49ers stadium, and that the city will enter a long-term $1 ground lease with the 49ers for a 17.4-acre Hunters Point Shipyard site.

Meanwhile, disgruntled community advocates claim that since January, when Feinstein, House Speaker Nancy Pelosi and Mayor Gavin Newsom announced $82 million in federal funding for the cleanup of the Hunters Point Shipyard site, those funds have gone primarily to cleaning up the potential 49ers site.

Power possibilities

GREEN CITY San Francisco’s energy future is in flux. On Nov. 4, voters decided the fate of Proposition H, a plan for 100 percent renewable energy by 2040. On the same day, the Board of Supervisors was set to consider a proposal from Mayor Gavin Newsom to retrofit the 32-year-old Mirant Potrero power plant to meet a state mandate for local electricity generation.

The results of both votes occurred after the Guardian deadline, but either way, the city’s energy policy is uncertain, particularly after serious doubts about the viability of the mayor’s proposal were raised at an Oct. 22 Land Use and Economic Development Committee hearing.

The retrofit was hastily developed as an alternative to longstanding plans to replace heavily polluting units of the Mirant plant with new, cleaner, city-owned peaker plants. That plan was derailed after a meeting in May between Newsom and seven Pacific Gas and Electric Co. executives, who were apparently concerned about the city generating its own power.

The Mayor’s office calls the retrofit a "bridge" to a renewable energy future and contends it can be cheaper than and as clean as the city’s peakers. Yet at the hearing, Mike Martin, who’s evaluating the retrofit project for the San Francisco Public Utilities Commission, said no retrofits have ever reached the emissions goals cited in Newsom’s proposal.

Jeff Henderson, senior project manager for Mirant, defended the $80 million price tag for the project (which is about $30 million cheaper than the city’s plan) but also said that they were "giving a price on a project that’s never been done before." Martin said the permits alone would be twice the price stated in a Mirant-commissioned feasibility study.

Chair of the committee Sup. Sophie Maxwell, who represents the district where the plant is sited, cast cost aside, saying that human lives and the lowest possible emissions were more important to her. Her district has the highest incidences of asthma and cancer in the city.

The retrofit would still emit more nitrogen oxide, carbon monoxide, sulfur dioxide, and particulate matter than the city’s peaker plants but the Mayor’s Office is banking on it operating less, thus emitting less overall. The numbers crunched for the study by CH2M Hill presume Mirant operating about 156 hours a year, though it is permitted for 877 hours. The city has sued the company in the past for exceeding its permitted hours.

When questioned if the 97 percent emissions reduction proposed was possible, Henderson said, "The only thing that leads us to believe that is we had vendors who would say they could meet that under contract."

Maxwell invited three potential vendors to the hearing. All said the industry standard was 90 percent emissions reduction and that it was infeasible, if not technically impossible, to reach 97 percent. To try may even result in a net gain of particulate matter emissions because the plant would need more ammonia catalyst.

But the Mayor’s Office remained confident in the project. "The experts that presented before the committee were all experts attached to the CT project, so I would not consider them independent third-party experts," Newsom’s director of government affairs Nancy Kirshner-Rodriguez told the Guardian.

Bruce Schaller, vice president of Kansas-based power company Sega, said he wouldn’t bid on this job under the current parameters because, "We would be associated with a project that was a failure."

Tom Flagg, president of Equipment Source Company, said the project was "completely illogical and impossible to do." He pointed out that emissions vary widely. "You have surges in emissions levels. Sometimes it’s 94 percent, sometimes it’s 84 percent … A 97 to 98 percent reduction is impossible because in order to maintain that they have 100 percent reduction at times. It’s an average."

The need for new power generation in San Francisco has been pushed by the California Independent System Operator (Cal-ISO), but environmental groups have urged the city to challenge that mandate. Former California Public Utilities Commission president Loretta Lynch, who spoke against the retrofit plan at the hearing, told the Guardian afterward, "The ISO are ideologues, not engineers. They have no basis in fact that we need any peninsula power production."

Supervisors passed a resolution asking the SFPUC to develop a transmission-only plan to meet Cal-ISO’s reliability demands. The SFPUC said it will present something within the next couple of months.

Nix Lennar’s higher profit deal

EDITORIAL The troubled homebuilder that wants to develop the Hunters Point Shipyard and Candlestick Point has come back to the city asking for a higher profit level, more market-rate housing, more retail, and more office space. In essence, Lennar Corp. wants to change the deal voters approved in June. The supervisors should give this a hard look, hold hearings, and check the numbers, because the entire project is looking more shaky and dubious by the day.

Lennar is one of the nation’s largest residential development companies, but it’s been walloped by the drop in the housing market. A Lennar project at Mare Island recently went bust and is being auctioned off. The company’s stock has tanked. And some wonder if it will be able to get the financing necessary for a multibillion dollar project in San Francisco.

But Lennar is not only moving forward — it’s demanding more. In fact, as Sarah Phelan reports on page 16, the Redevelopment Agency just signed a deal with Lennar agreeing that the city and the project sponsor "will work cooperatively to reduce risks and uncertainties" and "find additional efficiencies and values" to achieve the developer’s proposed 22.5 percent annual return target.

That 22.5 percent — which is far more profit than many San Francisco businesses ever make and seems almost obscene in this economic climate — is up 7.5 percent from when the deal was first signed. And remember, Lennar gets the land — public land — essentially free.

Of course, a consulting firm the city hired to evaluate the deal finds that perfectly reasonable. The firm, CBRE Consulting, is a subsidiary of CB Richard Ellis, a global real estate firm headed by Richard Blum, who is married to Sen. Dianne Feinstein, a big supporter of the Lennar plan.

The original plan called for 8,500 to 10,000 housing units; that’s now up to 10,500. There’s no significant increase in community amenities, affordable housing, or infrastructure payments.

If this sounds a little funky, it is. From the start, Lennar has been playing around with the numbers and promising more than it may be able to deliver. And if the project starts to go belly up before it’s finished, Lennar will walk away and leave the city with the mess.

We’ve always been a bit dubious about the way the Redevelopment Agency turns to a single "master developer" and gives that private outfit exclusive rights to build on a large piece of land. The deal always seems to be a lot better for the builder than it is for the city.

And this one was bad from the start. At the most, Lennar would offer 25 percent of the units at below-market rates; that’s less than half the amount of affordable housing mandated in the city’s general plan. Much of the land on the site is toxic, and Lennar has been steeply fined by the air quality board for failing to control asbestos dust. The whole concept of a suburban-style community of luxury condos with special freeway access in southeastern San Francisco is inappropriate, if not bizarre.

But voters approved the program after Lennar spent millions on a ballot measure campaign, so the city has to continue working with the developer. But there’s nothing that says the supervisors have to sign off on changes in the deal that don’t serve San Francisco’s interests.

The board ought to demand, at the very least, that Lennar devote some of its higher profit margin to increasing affordable housing — and that the funding for community amenities should be set aside before the builders break ground on the luxury condos. Ideally this entire thing should go back to the drawing board. But short of that, any changes need to benefit the city, not the private developer.

Cheng pulls in fourth for District 3

At 10 p.m., Claudine Cheng was in high spirits despite that the polls indicated she was in fourth for District 3 supervisor. With 8 percent of the vote she was far behind David Chui, who currently leads with 38 percent, according to the San Francisco Department of Elections Web site.

Surrounded by local residents, family, friends and a great food spread, Cheng, former deputy attorney for the city and Treasure Island Development Authority President, pointed out that the real results won’t be in until Friday. Besides, there was plenty of cheering in the room for Barack Obama, who had just won the presidency.

However, Cheng’s campaign manager, Ryan Chamberlain, wasn’t so upbeat at the moment. He said that he knew a couple of weeks ago where her race for District 3 supervisor was headed.

“A few weeks ago it became a Joe Alioto versus David Chui race … not so much about what they were doing or what they were saying but because of the negativ[ity],” said Chamberlain. “ The left started beating up on Joe … the right started beating up on David. The name recognition was that you’re either on side or the other. When that happened I could tell we just started to get lost in the debate.”

Competing political narratives in SF

San Francisco looks very different depending on where you stand. And that point is certainly being driven home this election season as voters hear two very different political narratives about The City.

One expresses great pride that San Francisco is setting an example for cities across the country in strongly opposing excessive militarism; mandating that workers receive a living wage and decent benefits; protecting tenants from eviction, harassment, and unaffordable rents; maintaining a social safety net; demanding developers provide community benefits; seeking clean energy sources; creating a tax structure that favors small local businesses over large corporations; standing up for the rights of the LGBT and immigrant communities; treating prostitution, drug use, and quality-of-life crimes as social problems rather than strictly criminal matters; and generally standing up for the broad public interest against the self-interest of the wealthy and privileged.

The other side mocks such namby-pamby ideals, arguing that only free markets unfettered by government regulation can create social and economic progress, and that anyone who doubts that is either stupid or unrealistic. They decry taxes (but expect taxpayer support for things like promoting tourism, sweeping streets of trash and the homeless, and subsidizing drivers and development) and consider government a bloated, malevolent entity that is far less trustworthy than corporations. Job creation is their top stated concern (but public sector jobs don’t count). They value unwavering patriotism, property rights, and robust, risk-taking capitalism and generally consider the poor and their sympathizers to be lazy, morally deficient complainers who deserve their lowly status. And they think progressives (actually, “ultra-liberal” is their preferred label) are destroying the city.

Which narrative rings true to you? Because where you stand will largely determine how you vote on Tuesday.

Shades of green

California’s major environmental groups have long called for the state to do more to promote a switch to renewable energy sources, yet they widely oppose two state ballot measures that claim to do so, urging votes to reject Propositions 7 and 10 as false promises. On the local level, however, the environmental community strongly supports Proposition H, the Clean Energy Act, against well-funded attacks by Pacific Gas & Electric Co.

Prop. 7 would require utilities to acquire half their power through renewable energy resources, and Prop. 10 would provide $5 billion in alternative fuel research and development. Dan Kalb, policy coordinator for the Union of Concerned Scientists, believes the basic goal of Prop. 7 is great, but that its execution would not work. "It’s something that sounds very good," Kalb told us. "Everyone is concerned about renewable energy, but we can’t afford to pass a law that isn’t going to work."

Opponents of Prop. 7 have argued that it is poorly written, would decrease current fine levels for noncompliance, and has many loopholes that only the largest producers can take advantage of. Natural Resources Defense Council media director Craig Noble told us, "It just doesn’t make sense. It’s deeply flawed … it’s so poorly written."

Proponents claim that it’s not poorly written, but that opponents have simply misread it. For example, opponents say Prop. 7 could exclude small businesses that generate less than 30 MW of renewable power. But proponents say they have misread Section 14 of the proposition, causing this confusion. Yet on Aug. 7 a Superior Court judge ruled that Prop. 7 could exclude those small businesses.

In all, the Yes on 7 campaign has 25 endorsements from politicians, organizations, and groups while the No on 7 campaign has more than 400 from politicians, organizations, groups, and cities opposing the measure.

"We’re extremely concerned that [Prop. 7 will] set us back, not move us forward," Kalb said.

If passed, Prop. 10 will authorize $5 billion in general obligation funds for alternative fuel research and development, but require $10 billion to be paid back over 30 years once interest has been figured in. Richard Holober, executive director of Consumer Federation, called the measure, "a $10 billion raid on California’s treasury."

He went on to tell the Guardian that public support for research of this kind is important, but that, "Prop. 10 has no accountability. It is filled with incredibly huge loopholes."

Under Prop. 10, a rebate will be given to consumers who purchase clean energy cars. At the same time, they can keep their old vehicles and potentially sell them. Yes on 10 media contact Amy Thoma confirmed this. Holober stated that California already has programs in place that require owners to scrap or donate their polluting vehicles after they receive a rebate; they also require residency in California.

Opponents of Prop. 10 also point out that the proposition requires no net decrease in pollution, meaning that new vehicles can be as polluting as those they replace, as long as they do not pollute more. Yet Thoma claims the measure will reduce emissions by a total of 4.1 million tons per year.

Noble told the Guardian: "We need to be reducing our dependence on fossil fuels, but Props. 7 and 10 are not the way to do it."

As for Prop. H, the measure would require that by 2017, half the energy sold in San Francisco would be from renewable energy sources, rising to 100 percent by 2040. It also calls for the city to study how best to achieve that goal, including if public power projects could play a role.

Corey Cook, an associate professor of political science at the University of San Francisco, told the Guardian that "Prop H is a small but not insignificant first step toward public power in San Francisco. [It] authorizes, but doesn’t actually do anything aside from creating a study to determine the feasibility and cost of buying out PG&E’s electricity grid and having the city generate power."

Environmentalists have rejected Props. 7 and 10 because they are written poorly and counterproductive, but they embrace Prop. H because it simply increases renewable energy standards, includes numerous procedural safeguards, and, as Cook said, "takes a first step toward public power."

Downtown’s planner

The battle for the district 1 supervisor’s seat is being framed largely by politically conservative groups, funded by real estate and development, that are spending thousands of dollars supporting former planning commissioner Sue Lee over school board member Eric Mar.

An incestuous web of independent expenditure and political action committees have collectively spent enough against Mar to blow the $140,000 cap off the voluntary expenditure ceiling that all the candidates in that district agreed to.

The money’s coming from the Building Owners and Managers Association, Plan C, the Coalition for Responsible Growth, and the San Francisco Association of Realtors. Although these groups can’t legally work directly with candidates, they typically swap funds among each other and receive outside support from the deep pockets at the Chamber of Commerce, Committee on Jobs, and Pacific Gas and Electric Co.

According to Ethics Commission executive director John St. Croix, the $140,000 cap was lifted on Friday, Oct. 24, which means the candidates are now free to spend up to their individual campaign limits, which are different for Lee, Mar, and Alicia Wang, the other major contender for the seat.

All three are receiving public financing — but so much outside money is being spent in support of Lee that, to keep pace, the individual spending caps for Mar and Wang have been raised and are now higher than Lee’s.

AGAINST THE NEIGHBORHOODS


Lee, who worked for Willie Brown’s mayoral administration and was public relations director for the Chamber of Commerce, now runs the Chinese Historical Society of America. Her voting record on the Planning Commission has been consistently pro-development and anti-neighborhood. Some examples from her final months on the commission:

<\!s> On April 10, 2008, she approved a mixed-use development at 736 Valencia St. and removed community benefits and below-market-rate unit requirements — against the wishes of community members and housing rights activists.

<\!s> On March 27, 2008, she was the only commissioner to vote against modifications to a rooftop remodeling project at 1420 Montgomery St. that would have pacified neighbors concerned about the scale and character of the plan.

<\!s> On March 13, 2008 she supported a conditional-use permit for a formula-retail paint store at Cesar Chavez and South Van Ness despite concerns about its effect on nearby small businesses.

<\!s> On Feb. 28, 2008, she approved a remodeling of a two-story flat on Potrero Ave. that opponents, including the next-door neighbors, characterized as a demolition in disguise.

"Her voting record for the past three years is crystal clear," one lawyer who represents neighborhood interests at the commission told us. "Given a choice between supporting neighborhood interests, long-term residents and the interests of the little guy or supporting development interests and the big- money people who are busy in our residential neighborhoods, she chooses the latter every time."

The lawyer, who regularly appears before the planning panel and asked not to be named, added: "She has supported big-box retail in our neighborhoods over the objections of neighbors. She has supported the destruction of rent-controlled housing and low-scale, more affordable housing that is being remodeled out of existence."

"She’s a total pay to play," said Robert Haaland, a labor activist with Service Employees International Union Local 1021, which is deeply vested in independent expenditures supporting Mar. "Her donations can be tracked back to decisions she made as planning commissioner."

For example, Lee voted in favor of a plan by Martin Building Company to convert a city-owned building on Jessie Street into 25 luxury condos that now rent for about $3,000 a month. Martin’s owner, Patrick McNerney is a Lee campaign donor. Also contributing to Lee is Eric Tao of AGI Capital, which helped finance the Soma Grand development, a project opposed by sustainable growth organizations like Livable City, the San Francisco Bicycle Coalition, Walk SF, and the Sierra Club. Lee voted in favor of it.

In 2006, Lee approved lifting the downtown height restrictions from 150 feet to 250 feet for a 189-unit building with ground level retail on Howard Street. The project sponsor, Ezra Mercy, gave Lee’s campaign the maximum legal donation of $500.

In fact, her campaign has received thousands of dollars in individual contributions — and according to our analysis, more than half has come from real estate developers, attorneys, and builders, including some who appear frequently before the Planning Commission, such as executives from Wilson Meany Sullivan, CB Richard Ellis, and Millennium Partners.

Lee did not return a call seeking comment.

MISLEADING THE VOTERS


The same day the spending cap was lifted, Mar alleged the local Democratic Party’s name was being improperly used by a new group calling itself the "San Francisco Democratic Club." First reported by Paul Hogarth on the online news site BeyondChron, the club is apparently composed of Democratic County Central Committee defectors who disagreed with the party’s endorsements for the Nov. 4 election.

The group’s treasurer, Mike Riordan, is also a deputy political director of PG&E’s Stop the Blank Check Committee, which is mounting the $10 million campaign against the Clean Energy Act. PG&E gave $30,000 to this new democratic club, the members of which have not been revealed.

Riordan hired DCCC member Tom Hseih’s firm to send robocalls in Cantonese to Asian voters urging support for Lee over DCCC-endorsed Mar. The endorsement script referred to the group as the "San Francisco Democratic Party Club." Mar said it was a misleading way to align this new club with the DCCC.

When asked if the club’s use of the Democratic Party name and membership to support candidates and issues that haven’t received the party’s vote was their intention, Hsieh told the Guardian, "Yeah, and you know what? That’s covered under the First Amendment."

Sup. Aaron Peskin, who chairs the DCCC and spoke on its behalf in support of Mar at two recent rallies, said, "at minimum, it’s misleading. At maximum it’s a violation of the party rules and punishable by removal." He said there was a credible argument and evidence supporting Mar’s allegation, but that it’s something the DCCC would have to deal with in its own house, likely after Nov. 4.

District 3 supervisorial candidate Joe Alioto Jr., 36, has stated repeatedly on the campaign trail that he is not running on his family’s name.

But his lack of policy or political experience, combined with his campaign’s close ties to his sister, District 2 Sup. Michela Alioto-Pier — the most conservative and reactionary member of the Board of Supervisors — has progressives fearing he’ll be even more hostile to their values than his sister if he is elected this fall.

Records show that Alioto-Pier, 40, who was appointed by Mayor Gavin Newsom in 2004, consistently votes against the interests of tenants, workers and low-income folks. She recently sponsored legislation that passes increased water and sewer rates along to tenants. In the past, she has voted against relocation money for no-fault evictions and against limits on condominium conversions. And that’s just her record on tenants’ rights.

"Michela makes Sup. Sean Elsbernd look like a progressive," said Board President Aaron Peskin, who is termed out as D3 supervisor and has endorsed David Chiu as his preferred candidate to represent this diverse district, which encompasses Chinatown, North Beach, Fisherman’s Wharf and Telegraph Hill.

Alioto, who bought a $1.3 million Telegraph Hill condominium in 2004, has said in debates that he was proud to serve on the Telegraph Hill Dwellers Board for three years, citing his alleged involvement in stopping the Mills Corporation’s development at Piers 27 and 31, improving the Broadway corridor, and working on neighborhood parks.

But a former THD Board member says Alioto’s claims are wildly overstated.

"He did not achieve anything in North Beach as a board member," our source said. "His attendance was poor, he lacked leadership, and when he was asked to head a Broadway corridor subcommittee to tackle the Saturday night issue, he said no, he was too busy. He was on the opposite side of all our policies and goals. There were even questions whether he was residing in the district, when he house-sat for his parents in the East Bay."

In a March 2006 e-mail to THD members, Alioto acknowledges that he and his wife had indeed been house-sitting in the East Bay for months while his parents were in Italy. "Of course, I have never intended to stay in the East Bay, my being there for simply a temporary period," Alioto wrote, referring to the Supreme Court’s definition of residency, which he said he "relied on to continue to contribute to THD activities."

THD board members aren’t the only ones accusing Alioto of stretching the truth.

The Sierra Club’s John Rizzo is irate over the use of the club’s name in a recent Alioto campaign mailer in which Alioto claims that he helped create the San Francisco Climate Challenge "in collaboration with the Sierra Club and DF Environment."

"What he says is highly misleading," Rizzo told the Guardian. "It makes it sound like an ongoing effort he cofounded with the Sierra Club, but it was a one-time effort that, while worthwhile, only lasted a month and is over and done with."

Rizzo further noted that Alioto did not complete or return the Sierra Club’s candidate questionnaire, as is requested of candidates seeking the club’s political endorsement. Alioto also has ruffled feathers by claiming that he prosecuted criminal cases while working in the Alameda County District Attorney’s office in 1999.

Alameda County Senior Deputy District Attorney Kevin Dunleavy told the Guardian that Alioto was, in fact, "a summer intern, a student law clerk working under supervision" in 1999. "He got to prosecute a few cases under our supervision, including a misdemeanor jury trial, but he never worked as an actual deputy DA," Dunleavy said.

But Alioto’s alleged distortions have tenants’ rights advocates like Ted Gullicksen of the San Francisco Tenants Union wondering if Alioto will preserve rent control and try to abolish the Ellis Act, as he has promised on the campaign trail. Alioto never completed a Tenants Union candidate endorsement questionnaire, and has a massive amount of financial backing from the same downtown real estate and business interests that support his anti-tenant sister, Alioto-Pier.

Campaign disclosures show that Alioto’s campaign consultant, Stephanie Roumeliotes, led the Committee to Reelect Michela Alioto-Pier in 2006. Roumeliotes is also working on two other political campaigns this fall: No on B, which opposes the affordable housing set-aside, and Yes on P, which supports giving Mayor Newsom even greater control of how transportation funds are allocated and spent, and which even Alioto-Pier joined the Board of Supervisors in unanimously opposing.

Public records show that the Alioto siblings have 160 of the same campaign contributors. These include Gap founder Donald Fisher, wealthy socialite Dede Wilsey, and Nathan Nayman, former executive director of the Committee on Jobs, a downtown political action committee funneling big money into preferred candidates like Alioto.

All of which has progressives worrying that Alioto and his sister could become the Donny and Marie Osmond tag team for the same Republican downtown interests that are seeking to overturn the city’s universal health care and municipal identity card programs.

Talking by phone last week after months of stonewalling the Guardian’s requests for an interview, Alioto told us that he admires his sister very much, but that does not mean he shares her beliefs. "She has been through more in her relatively short life than most of us, and she does a great job representing her district," Alioto said. "But we are not the same people. Just because we are siblings does not mean we think the same."

Noting that, unlike his sister, he supports Proposition M, (which would protect tenants from landlord harassment), Alioto said, "If Michela ever proposed legislation that I thought was bad for the district and city, I’d vote against it."

Asked why he opposes the affordable housing measure Prop. B, Alioto told us that he doesn’t think that "locking away any more of our money helps … but I support affordable housing for low-income folks, including rental units, and we need more middle-income housing for police officers, firefighters, nurses and teachers."

As for his endorsement by the rabidly anti-rent control SF Small Property Owners, Alioto said, "I think people are supporting me because I’d be fair and reasonable."

Alioto, who attended Boalt Hall School of Law at UC Berkeley and works as an antitrust lawyer at the Alioto Law Firm with brother-in-law Tom Pier, insists that he never claimed he’d been a deputy DA, "but I have a proven record of being interested in putting criminals behind bars."

Noting that he supports the property tax measures on the ballot, "notwithstanding the fact that some real estate interests supporting my campaign are opposed," Alioto further claimed that estimates that a third of his campaign money is from real estate interests are "severely overblown."

"I think they must have been including architects," he told us.

Asked about the Golden Gate Restaurant Association’s lawsuit against the city’s universal health care ordinance, Alioto said he supports Healthy San Francisco, "but I am concerned a little about putting the burden on small business."

Claiming that he supports the mayor’s community justice center as well as "funding for whatever programs it diverts people to," Alioto talked about kick-starting the economy in blighted areas by creating jobs and incentives for small businesses in those districts. Alioto, who just saw the San Francisco Small Business Advocates kick down $9,500 in support of his campaign, also said he wants to increase the number of entertainment permits, add a movie theater, and decrease parking fees in Chinatown.

"And I support the [Chinatown] night markets," Alioto said, referring to a pet project of Pius Lee, whose Chinatown neighborhood association was found, during a 2006 audit instigated by Peskin, to have received excess city funds and allowed unlicensed merchants to participate in the markets.

But Lee is evidently now in good standing with Alioto and Mayor Gavin Newsom, since he accompanied both on a recent walkabout to boost Alioto’s standing with Chinatown merchants. And Alioto’s election is apparently very important to Newsom, given that the first public appearance the mayor made after returning from his African honeymoon was on behalf of Alioto’s campaign.

All of which seems to confirm progressives’ worst fears that Alioto, just like his sister before him, will become yet another Newsom call-up vote on the board. Three ethics complaints were filed against the Alioto campaign this week, and his detractors say he has a long history of questionable behavior, going back to 1996 when he had a severe ethical lapse while working on his sister’s campaign for Congress.

According to a July 27, 1996 Chronicle article, Alioto, who was then his sister’s campaign adviser, and their cousin, college student Steve Cannata, admitted they conspired to intercept the campaign material of Michela’s congressional opponent, Frank Riggs.

"If Miss Alioto tolerates this sort of deceit in her campaign, it is frightening to imagine how she would behave if ever elected," Riggs wrote at the time. Alioto-Pier lost that race. But if her brother wins this November, can progressives help but be a little frightened to imagine just how the Alioto siblings might behave?

As one observer who preferred to remain anonymous told us, "Alioto may be all Joe Personality on the campaign trail, and have the same photogenic smile as his sister, but in reality, he is a fraud."

The stealth candidate

Ahsha Safai is hoping to be elected to the Board of Supervisors without answering questions about his padded political resume of short-lived patronage jobs, greatly exaggerated claims of his accomplishments, history as a predatory real estate speculator, connections to and coordination with downtown power brokers, shifting and contradictory policy positions, or the many other distortions this political neophyte is offering up to voters in District 11, a crucial swing district that could decide the balance of power in city government.

Safai has refused numerous requests for interviews with the Guardian over the last two months. We’ve even left messages with specific concerns about his record and positions. But our investigation reveals his close political ties to the downtown interest groups that have spent close to $100,000 on his behalf and shows him to be a shameless opportunist who is apparently willing to say anything to achieve power.

There’s much we don’t know about Ahsha Safai, but there’s enough we do know for a consistent yet troubling portrait to emerge.

Safai moved to San Francisco from Washington, DC with his lawyer wife in 2000, and immediately began to ingratiate himself into the mainstream Democratic Party power structure, starting as a legislative liaison with the corruption-plagued San Francisco Housing Authority and joining Gavin Newsom’s mayoral campaign in 2003.

Safai became a protégé of Newsom’s field director Alex Tourk, who was a top Newsom strategist for several years until he abruptly resigned after learning that Newsom had an affair with his wife. With support from Tourk (who didn’t respond to our calls about Safai) and Newsom, Safai held a string of city jobs over the next three years, moving from the Mayor’s Office of Community Development to the Mayor’s Office of Neighborhood Services to the Department of Public Works, all of which he touts on his Web ite, greatly exaggerating (and in some cases, outright misrepresenting) his accomplishments in each, according to those who worked with him. (Few sources who worked with Safai would speak on the record, fearing repercussions from Newsom).

THE CONNECT DISASTER


One project Safai doesn’t mention on his Web site is his work spearheading Community Connect, the most disastrous of Newsom’s SF Connect programs. "It’s the one Connect that the mayor will never talk about," said Quentin Mecke, who participated in the effort, on behalf of nonprofit groups, to create a community policing system. "The whole thing just devolved into chaos and there weren’t any more meetings."

In 2005, Safai and Tourk convened meetings in each of the city’s police precincts to take testimony on rising violence and the failure of the San Francisco Police Department to deal with it. Ultimately Newsom decided to reject a community-policing plan developed through the process by the African-American Police Community Relations Board. That set up the Board of Supervisors to successfully override a mayoral veto of police foot patrols.

"Ahsha’s approach was consistent with the Newsom administration, with folks that talk a good game but there’s no substance behind it," said Mecke, who ran for mayor last year, placing second.

Another realm in which Safai has claimed undeserved credit is on his efforts to save St. Luke’s Hospital from attempts by the California Pacific Medical Center (and CPMC’s parent company, Sutter Health) to close it or scale back its role as an acute care provider for low income San Franciscans.

"When I looked at his campaign material and he says he was a leader who saved St. Luke’s, I thought, ‘Am I missing something here?," Roma Guy, a 12-year member of the city’s Health Commission and leader in the effort to save St. Luke’s, told the Guardian. "Nobody thinks Ahsha has taken a leadership role on this. This is a significant exaggeration from where I sit."

Nato Green, who represents nurses at St. Luke’s within the California Nurses Association, went even further than Guy, saying he was worried about Safai’s late arrival to the issue (Safai wasn’t part of the group that protested, organized, and urged CPMC to agree to rebuild the hospital) and the fact that CPMC appointed Safai to its Community Outreach Task Force as the representative from Distrist 11.

"From our point of view, he is the CPMC’s AstroTurf program, simuutf8g community participation," Green told us. "It’s critical to us that we end up with a supervisor who is independent of CPMC and will go to the mat for what the community needs."

CNA has endorsed Avalos in the District 11 race.

"John was the only candidate in District 11 who came out and spoke at the hearings, attended the vigils, and walked the picket line during the strikes," Green said.


REAL ESTATE SPECULATION


Beyond his association with downtown power brokers and endorsement by Newsom, there are other indicators that Safai is hostile to progressive values. He said in a recent televised forum that he would work most closely with supervisors Carmen Chu, Sean Elsbernd, and Michela Alioto-Pier, the three most conservative members of the Board of Supervisors.

During an Oct. 14 Avalos fundraiser hosted by sustainable transportation advocates Dave Snyder, Tom Radulovich, and Leah Shahum, attendees expressed frustration at Safai’s tendency to pander to groups like the San Francisco Bicycle Coalition, taking whatever position he thinks they want to hear without considering their implications or consistency with his other stands.

"It was a no-brainer for the Bike Coalition to endorse John," Shahum, SFBC’s executive director, said at the event, noting Avalos’ long history of support for alternatives to the automobile.

Avalos, who had been hammered all week by mailers and robocalls from downtown groups supporting Safai, said he was frustrated by the barrage but that "we can fight the money with people.

"Ahsha has done everything he can to blur the lines about what he stands for," Avalos said. "Whoever he’s talking to, that’s who he’s going to be. But we need principled leadership in San Francisco."

One area where Safai doesn’t appear to be proud of his work is in real estate, opting to be identified on voting materials as a "nonprofit education advisor." One of his opponents, Julio Ramos, formally challenged the designation, writing to the Election Department that the label "would mislead voters and is not factually accurate, the term ‘businessman’ or ‘investor’ denotes the true livelihood of candidate Safai."

Safai responded by defending the title and writing, "My dates of employment at Mission Language Vocational School were from August 2007 through February 2008." So, because of his seven-month stint at this nonprofit, voters will see Safai as someone who works in education, even though his financial disclosure forms show that most of his six-figure income comes from Blankshore LLC, a Los Altos-based developer currently building a large condo project at 2189 Bayshore Blvd. that is worth more than $1 million. (That’s the top value bracket listed on the form, so we don’t know how many millions the project is actually worth or how much more than $100,000 Safai earned this year).

But we do know from city records that Safai has personally bought at least three properties during his short stint in San Francisco, including one at 78 Latona Street that he flipped for a huge profit after buying it from a woman facing foreclosure, who then sued Safai for fraud.

The woman, Mary McDowell, alleged in court documents that real estate broker Harold Smith, "unsolicited, came to plaintiff’s residence and offered assistance to her because her homes were in foreclosure … [and said] she would receive sufficient money after sales commissions to reinstate the loans on the four other properties."

The legal complaint said Smith then modified those terms to pay McDowell less than promised and arranged to sell the home to Safai and his brother, Reza. "Plaintiff is informed and believes and thereon alleges that defendants did not promptly list her residence on the multiple listing service to avoid larger offers on the home and conspired with the other defendants to purchase the home at a far less than market price," reads the complaint.

The case was originally set for jury trial, indicating it had some merit. But after numerous pleadings and procedural actions that resulted in the plaintiff’s attorney being sanctioned for failing to meet certain court deadlines and demands, the case was dismissed.
But whatever the merit to the case, records on file with the county assessor and recorder show that Safai and his brother flipped the property for a tidy profit. They paid $365,500 for the place in December 2003 — and sold it two year later, in December 2005, for $800,000.
Labor activist Robert Haaland told us that Safai can’t be trusted to support rent control or the rights of workers or tenants: "At the end of the day, he’s a real estate speculator."

Mayor’s power plant plan flawed

Or, as Sup. Aaron Peskin put it one point during the dramatic Wed. Oct. 22 Land Use and Economic Development committee hearing, “The only thing holding this proposal together is the staple in the upper left hand corner.”

Under discussion was Mayor Gavin Newsom’s plan to retrofit 32-year-old Mirant Potrero power plant Units 4,5, and 6 to run on natural gas rather than diesel and be 97.5 percent cleaner than current operations – a retrofit and emissions reduction that’s never been accomplished and might be impossible, according to testimony from industry experts called in by committee chair Sup. Sophie Maxwell.

The plan arose in June, after a May 23 tête-à-tête between Newsom and seven Pacific Gas & Electric executives just as the Board of Supervisors was preparing to vote on a plan to construct a new power plant to replace Mirant and meet state energy requirements. PG&E opposed the new plant (referred to as the “CTs”) as it would have been owned by the city, eroding the utility company’s control of local energy resources. Prior to the May meeting, Newsom had been part of a coalition of city officials, which included city attorney Dennis Herrera and Supes. Maxwell and Peskin, who supported the new plant and had been fostering it forward for several years as a way to close down Mirant’s more polluting operations. Newsom pushed for support of retrofitting Mirant instead, billing it as a cheaper alternative that could be just as clean as the new city-owned combustion turbine facility that had been proposed.

But the results of a July feasibility study [PDF], completed by CH2M Hill and currently part of the SFPUC’s negotiations with Mirant, had Peskin comparing the idea to retrofitting a 1974 Chevy rather than going for a new Toyota Prius.

A score of issues came up as the study was discussed during what proved to be a very revealing hearing. They include an assumption of reduced air emissions for the retrofit based on reduced runtimes for a plant that the city has sued in the past for operating more than it was legally permitted, a possible ducking of CEQA environmental review, a lack of established regulatory oversight of the plant, an emissions control system that “predicts” rather than actually measures pollution, an understated project cost of $78,730,000 and the fact that executives from energy companies that routinely bid on such retrofit projects testified that they wouldn’t go anywhere near this one.

Transportation is the linchpin of sustainability. Fix the transportation system, and almost every other aspect of the city’s ecological health improves: public health, conservation of resources, climate change, economics, and maintaining our culture and sense of community.

The region’s unsustainable transportation system is the biggest cause of global warming (more than half the Bay Area’s greenhouse gas emissions come from vehicles) and one of the biggest recipients of taxpayer money. And right now, most of those public funds from the state and federal governments are going to expand and maintain freeway systems, a priority that exacerbates our problems and delays the inevitable day of reckoning.

It’s going to have to change — and we can do it the easy way or the hard way.

“We’ll get to a more sustainable transportation system. The question is, are we going to be smart enough to make quality of life for people high within that sustainable transportation system?” said Dave Snyder, who revived the San Francisco Bicycle Coalition and founded Transportation for a Livable City (now known as Livable City) before becoming transportation policy director for the San Francisco Planning and Urban Research Association. “People will drive less, but will they have dignified alternatives? That’s the question.”

That notion — that transportation sustainability is inevitable, but that it’ll be painful if we don’t start now in a deliberate way — was shared by all 10 transportation experts recently interviewed by the Guardian. And most agreed that needed reform involves shifting resources away from the automobile infrastructure, which is already crowding out more sustainable options and will gobble up an even bigger piece of the pie in the future if we continue to expand it.

“Yeah, it’ll be more sustainable, but will it be just? Will it be healthful? Will it be effective? Those are the questions,” said Tom Radulovich, director of Livable City and an elected member of the BART Board of Directors. “You can’t argue against geology. The planet is running out of oil. We’re going to have a more sustainable transportation system in the future. That’s a given. The question is, is it going to meet our other needs? Is it going to be what we need it to be?”

And the answer to all those questions is going to be no — as long as politicians choose to fund wasteful projects such as a fourth bore in the Caldecott Tunnel and transferring $4 billion from transit agencies to close California budget deficits accruing since 2000.

“Our leaders need to be putting our money where our collective mouth is and stop raiding these funds,” Carli Paine, transportation program director for Transportation and Land Use Coalition, told us. “I’m hopeful, but I think we all need to do more.”

 

TRANSIT AND BIKES

There is reason to be hopeful. With increased awareness of global warming and high gasoline prices, public transit ridership has increased significantly in the Bay Area. And one study indicates that the number of people bicycling in San Francisco has quadrupled in the last few years.

“Look at what’s happening on the streets of San Francisco: you have biking practically doubling every year without any new bike infrastructure. I think the demand is out there. The question is, when is the political leadership going to catch up to demand?” Jean Fraser, who sits on the SPUR and SFBC boards and until recently ran the San Francisco Health Plan under Mayor Gavin Newsom, told us.

But the political leadership and federal transportation spending priorities are behind the times. Of the $835 million in federal funds administered by the Metropolitan Transportation Commission for the nine Bay Area counties in 2006-07, 51.4 percent went to maintain and expand state highways. Only 2.5 percent went for expansion of public transit, and 2.4 percent for bike and pedestrian projects. Overall, Paine said, about 80 percent of all state and federal transportation funding goes to facilities for automobiles, leaving all modes of transportation to fight for the rest.

“Historically we favor the automobile at the expense of all those other modes,” Radulovich said at a forum of experts assembled by the Guardian (a recording of the discussion is available at sfbg.com). “It’s been given primacy, and I think everyone around this table is saying, in one way or another, that we need a more balanced approach. We need a more sustainable, sensible, and just way of allocating space on our roads.”

Yet the Bay Area is now locking in those wasteful patterns of the past with plans for about $6 billion in highway expansions, which means the MTC will have to spend even more every year keeping those roads in shape. Highway maintenance is the biggest line item in the MTC budget, at $275 million.

“We can’t pay for what we have now — to maintain it, repair it, seismically retrofit it — so why we’re building more is kind of beyond me,” Radulovich said. “We continue to invest in the wrong things.”

The experts also question big-ticket transit items such as the Central Subway project, a 1.7-mile link from SoMa to Chinatown that will cost an estimated $1.4 billion to build and about $4 million per year to run.

“There are 300 small capital projects we need to see,” Snyder said. “That’s really the answer. The idea of a few big capital projects as the answer to our problems is our problem. What we really need are 100 new bike lanes. We need 500 new bus bulbs. We need 300 new buses. It’s not the big sexy project, but 300 small projects.”

The most cost-efficient, environmentally effective transportation projects, according to renowned urban design thinkers such as Jan Gehl from Denmark, are those that encourage walking or riding a bike.

“I think Jan Gehl put it best, which is to say a city that is sweet to pedestrians and sweet to bicyclists is going to be a sustainable city,” Fraser said. “So I think focusing on those two particular modes of transportation meets the other goals of the financial viability because they’re the cheapest ways to get people around — and the healthiest ways — which I submit is one of the other criteria for sustainable transportation…. And it helps with the social justice and social connections.”

 

IT’S GOOD FOR YOU

In fact, transportation sustainability has far-reaching implications for communities such as San Francisco.

“I think of sustainability in two ways,” Fraser said. “The first is sustainability for the environment. And since I have a background in health care, I think of a sustainable transportation system as one that’s actually healthy for us. In the past at least 50 years, we’ve actually engineered any kind of active transportation — walking to work or to school, biking to school — out of our cities.”

But it can be engineered back into the system with land use policies that encourage more density around transit corridors and economic policies that promote the creation of neighborhood-serving commercial development.

“If my day-to-day needs can be met by walking, I don’t put pressure on the transportation system,” Manish Champsee, a Mission District resident who heads the group Walk SF, told us.

The transportation system can either promote that sense of community or it can detract from it. Champsee said San Francisco needs more traffic-calming measures, citing the 32 pedestrian deaths in San Francisco last year. Almost a third as many people are killed in car accidents as die from homicides in San Francisco — but murder gets more resources and attention.

“There’s a real sense in the neighborhoods that the roadways and streetscapes are not part of the neighborhood, they’re not even what links one neighborhood to another. They’re sort of this other system that cuts through neighborhoods,” said Gillian Gillette of the group CC Puede, which promotes safety improvements on Cesar Chavez Street.

Radulovich notes that streets are social spaces and that decisions about how to use public spaces are critical to achieving sustainability.

“A sustainable transportation system is one that allows you to connect to other people,” he said. “Cities have always thrived on connections between humans, and I think some of the transportation choices we’ve made, with reliance on the automobile, have begun to sever a lot of human connections. So you’ve got to think about whether it’s socially sustainable. Also economically sustainable, or fiscally sustainable, because we just can’t pay for what we have.”

So then what do we do? The first step will take place next year when Congress is scheduled to reauthorize federal transportation spending and policies, presenting an opportunity that only comes once every four years. Transportation advocates from around the country are already gearing up for the fight.

“We’ve built out the freeways. They’re connecting the cities — they’re pretty much done. So what do we need to do to make streets more vibrant and have more space for people and not just automobiles?” asked Jeff Wood, program associate for the nonprofit group Reconnecting America and the Center for Transit-Oriented Development.

Then, once communities such as San Francisco have more money and more flexibility on how to spend it, they can get to work on the other sustainability needs. “The key component is having all the transportation systems fully linked,” Paine said. That means coordinating the Bay Area’s 26 transit agencies; expanding on the new TransLink system to make buying tickets cheaper and easier; funding missing links such as connecting Caltrain from its terminus at King and Fourth streets to the new Transbay Terminal; and timing transfers so passengers aren’t wasting time waiting for connections.

And the one big-ticket transportation project supported by all the experts we consulted is high-speed rail, which goes before voters Nov. 4 as Proposition 1A. Not only is the project essential for facilitating trips between San Francisco and Los Angeles, it takes riders to the very core of the cities without their having to use roadways.

Paine also notes that the bond measure provides $995 million for regional rail improvements, with much of that going to the Bay Area. And that’s just the beginning of the resources that could be made available simply by flipping our transportation priorities and recognizing that the system needs to better accommodate all modes of getting around.

At the roundtable, I asked the group how much a reduction in automobile traffic we need to see in San Francisco 20 years from now to become sustainable — with safe streets for cyclists and pedestrians, free-flowing public transit, and vibrant public spaces. Sarah Sherburn-Zimmer, an organizer with SEIU Local 1021 and the Transit Not Traffic Coalition, said “half.” Nobody disagreed.

That may sound outrageous by today’s standards, when cars use about 30 percent of our roadways to handle about 5 percent of the people-moving (a similar ratio to how Americans constitute 5 percent of the world’s population but use more than 25 percent of the world’s resources). A sustainable, just, efficient mix would drastically beef up the operating budgets of Muni, BART, and other transit agencies, and transfer all the capital set aside for new freeways into new transit lines that would better serve, for example, the Sunset and Excelsior districts.

Alternative transportation advocates insist that they aren’t anti-car, and they say the automobile will continue to play a role in San Francisco’s transportation system. But the idea of sustainability means beefing up all the other, more efficient transportation options, so it becomes faster, cheaper, and easier to walk, bike, take transit, or rideshare (probably in that order of importance, based on the resources they consume). As Fraser said of residents choosing to drive cars, “We should make it so it’s their last choice.” *

 

Anniversary Issue: First, do no harm

Mayor Gavin Newsom announced last week that San Francisco is "on pace" to build a historic number of homes in a five-year period.

"Despite the housing crisis facing the nation, San Francisco is bucking the trends and creating a record number of homes," Newsom said. "Once again, San Francisco is leading the way."

But where?

Newsom notes that his housing-development plans will triple what San Francisco produced in the ’90s, and double the past decade’s housing production. He claims that he has increased the city’s production of affordable housing for low- and very-low-income households to the highest levels ever.

But he doesn’t point out that most people who work in San Francisco won’t be able to afford the 54,000 housing units coming down the planning pipeline.

The truth is that, under Newsom’s current plans, San Francisco is on pace to expand its role as Silicon Valley’s bedroom community, further displace its lower- and middle-income workers, and thereby increase the city’s carbon footprint. All in the supposed name of combating global warming.

So, what can we do to create a truly sustainable land-use plan for San Francisco?

<\!s> Vote Yes on Prop. B

In an Oct. 16 San Francisco Chronicle article, Newsom tried to criticize the Board of Supervisors for not redirecting more money to affordable housing, and for placing an affordable housing set-aside on the ballot.

"There’s nothing stopping the Board of Supervisors from redirecting money for more affordable housing," Newsom claimed. "Why didn’t they redirect money to affordable housing this year if they care so much about it?"

Ah, but they did. Newsom refused to spend the $33 million that a veto-proof majority of the Board appropriated for affordable housing last year. Which is why eight supervisors placed Prop. B, an annual budget allocation for the next 15 years, on the Nov. 2008 ballot.

<\!s> Radically redirect sprawl

The San Francisco Planning and Urban Research Association’s executive director, Gabriel Metcalf, notes that existing Northern California cities —San Francisco, Oakland, San Jose — already have street, sewer, and transit grids, and mixed-use development in place.

"So we don’t have to allow one more inch of suburban sprawl. We could channel 100 percent of regional growth into cities. Instead, we hold workshops and ask ‘How much growth can we accommodate? The answer is none, because no one likes to change."

Metcalf said he believes people should be able to work where they want, provided that it’s reachable by public transit.

"What’s wrong with taking BART to Oakland and Berkeley, or Caltrain to San Jose?" Metcalf said.

<\!s> Don’t do dumbass growth

Housing activist and Prop. B supporter Calvin Welch rails at what he describes as "the perversion of smart growth in local planning circles."

The essence of smart growth is that you cut down the distance between where people work and live, Welch explains.

"But that makes the assumption that the price of the housing you build along transit corridors is affordable to the workforce that you want to get onto public transit," Welch adds. "If it’s not, it’s unlikely they’ll get out of their cars. Worse, if you produce housing that is only affordable to the community that works in Silicon Valley, you create a big problem in reverse, a regional transit shortage. Because you are building housing for folks who work in a place that is not connected to San Francisco by public transit."

Welch says the city also needs to invest more in transit infrastructure.

Pointing to Market-Octavia and the Eastern Neighborhoods, Welch notes that while the City Planning Department is calling for increased density there, Muni is proposing service cuts.

"This is beyond bizarre," Welch said. "It will result in dramatic increases in density in areas that are poorly served by transit. That’s the dumbest kind of growth."

Welch says sustainable land use has local employment opportunities at its heart.

Noting that 70 percent of residents worked in San Francisco 20 years ago, Welch says that only a little over 50 percent of local jobs are held by San Franciscans today.

"Most local jobs are held by people who live outside San Francisco, and most San Franciscans have to go elsewhere to find work. It’s environmentally catastrophic."

<\!s> Protect endangered communities

Earlier this year, members of a mayoral task force reported that San Francisco is losing its black population faster than any other large US city. That decline will continue, the task force warned, unless immediate steps are taken.

Ironically, the task force’s findings weren’t made public until after voters green-lighted Lennar’s plan to develop 10,000 (predominantly luxury) units in Bayview-Hunters Point, one of the last African American communities in town.

San Francisco Redevelopment Agency Executive Director Fred Blackwell has since recommended expanding his agency’s certificate of preference program to give people displaced by redevelopment access to all of the city’s affordable housing programs, an idea that the Board of Supervisors gave its initial nod to in early October. But that’s just a Band-Aid.

And community leader and Nation of Islam Minister Christopher Muhammad has suggested creating "endangered community zones" — places where residents are protected from displacement — in Bayview-Hunters Point and the Western Addition.

"It’s revolutionary, but doable," Muhammad said at the out-migration task force hearing.

<\!s> Don’t build car-oriented developments

BART director and Livable City executive Tom Radulovich predicts a silver lining in the current economic crisis: "The city will probably lose Lennar."

He’s talking about two million square feet of office space and 6,000 square feet of retail space that Lennar Corp., the financially troubled developer, is proposing in Southeast San Francisco.

"We should not be building an automobile-oriented office park in the Bayview," Radulovich said. "Well-meaning folks in the Planning Department are saying we need walkable cities, but Michael Cohen in the Mayor’s Office is planning an Orange County-style sprawl that will undo any good we do elsewhere. This is the Jekyll and Hyde of city planning."

<\!s> Buy housing

Ted Gullicksen at the San Francisco Tenants Union says that since land in San Francisco only increases in value, the city should buy up apartment buildings and turn them into co-ops and land-trust housing.

"The city should try to get as much housing off-market as possible, grab it now, while it’s coming up for sale, especially foreclosed properties," Gullicksen said. "That’s way quicker than trying to build, which takes years. And by retaining ownership, the city also retains control over what happens to the land."

<\!s> Work with nonprofit developers

Gullicksen said that the city should work with small nonprofits, and not big master developers, to create interesting, diverse neighborhoods.

Local architect David Baker says nonprofits are more likely to build affordable housing than private developers, even when the city mandates that a certain percentage of new housing must be sold below market rate.

"Thanks to the market crash, very little market rate housing is going to be built in the next five years, which means almost no inclusionary," Baker explains. "During a housing boom, you can jack up that percentage rate to 15 percent, or 20 percent, but then the boom crashes, and nothing gets built."

Gullicksen says the good news is that planners are beginning to think about how to create walkable, vibrant, and safe cities.

"They are thinking about pedestrian-oriented entrances and transparent storefronts, about hiding parking and leaving no blank walls on ground floors. Corner stores, which are prohibited in most neighborhoods, are a great amenity.

"San Francisco needs to figure out where it can put housing without destroying existing neighborhoods, or encroaching on lands appropriate for jobs."

<\!s> Design whole neighborhoods

Jim Meko, chair of the SoMa Leadership Council, was part of a community planning task force for the Western SoMa neighborhood. He told us that one of the most important things his group did was think about development and preservation in a holistic way.

"WSOMA’s idea is to plan a whole neighborhood, rather than simply re-zoning an area, which is how the Eastern Neighborhoods plan started," Meko said. "Re-zoning translates into figuring out how many units you can build and how many jobs you will lose. That’s a failed approach. It’s not smart growth. If you displace jobs, the economic vitality goes elsewhere, and people have to leave their neighborhood to find parks, recreational facilities and schools."

Meko noted that "housing has become an international investment. It’s why people from all around the world are snapping up condos along the eastern waterfront. But they are not building a neighborhood."

San Francisco, Meko said, "has the worst record of any US city when it comes to setting aside space for jobs in the service and light industrial sector. But those are exactly the kinds of jobs we need. The Financial District needs people to clean their buildings, and I need people to repair my printing press. But I don’t like having to pay them $165 an hour travel time."

<\!s> Practice low-impact development

Baker recommends that the city stop allowing air-conditioned offices.

"We’ve got great weather, we need to retrofit buildings with openable windows," he said. "We should stop analyzing the environmental impact of our buildings based on national tables. This stops us from making more pedestrian friendly streets. And people should have to pay a carbon fee to build a parking space."

A citywide green building ordinance goes into effect Nov. 3 and new storm water provisions follow in January, according to the SFPUC’s Rosey Jencks.

This greening impetus comes in response to San Francisco’s uniquely inconvenient truth: surrounded by rising seas on three sides, the city has a combined sewer system. That means that the more we green our city, the more we slow down the rate at which runoff mixes with sewage, the more we reduce the risk of floods and overflows, and the more we reduce the rate at which we’ll have to pump SoMa, as rising seas threaten to inundate our sewage system.

The SFPUC also appears committed to replacing ten seismically challenged and stinky digesters at its southeast plant.

<\!s> Strictly control the type of new housing

Marc Salomon, who served with Meko on the task force, told us he thinks the city needs to create a "boom-proof" development plan, "a Prop. M for housing." That’s a reference to the landmark 1986 measure that strictly limited new commercial office development and forced developers to compete for permits by offering amenities to the city.

The city’s General Plan currently mandates that roughly two-thirds of all new housing be affordable — but the city’s nowhere near that goal. And building a city where the vast majority of the population is rich is almost the definition of unsustainability.

"Too much construction is not sustainable at any one time, nor is too much uniform development," Salomon said. "If we see too many banks, coffee shops or dot-com offices coming in, we need hearings. We need to adopt tools now, so can stop and get things under control next time one of these waves hits. And since infrastructure and city services are in the economic hole, we need to make sure that new development pays for itself." *

Anniversary Issue: A city transformed

When I first started writing about sustainable cities in the Guardian, I was 28, the paper was 20, urban environmentalism was still considered an oxymoron in much of the mainstream political world — and we didn’t have a name for what we were discussing.

In fact, the story I wrote on Oct. 15, 1986 was called "The city reconceived — a radical proposal" It was part of our 20th anniversary issue, but it wasn’t on the cover, and it wasn’t the lead feature. It was just something I had been thinking about a lot at the time, and since I was reporting a lot on everything that was wrong with city planning, it seemed to make sense to step back and talk about the way things ought to be.

It’s kind of strange to look back at that article today. So much has changed; so little has changed.

"It’s easy to argue that the problems are national, even international in scope, and that no progressive economic policy is possible without basic, fundamental changes in the US economic system," I wrote. "I’m sympathetic to that sort of argument, but somehow, it doesn’t satisfy me. A transformation of the nation’s economic orders is a long way off — and it may not be possible at all unless the seeds are sown at the local level."

I can see from the interviews I did back then the beginnings of what is now known internationally as the sustainable city movement. In 1986, there were a few scrawny nonprofits and a handful of academics; today there are think tanks, institutes, reports, studies, commissions. Mayors all over the world talk about sustainability; here in San Francisco, Gavin Newsom has a full-time $130,000-a-year staffer dedicated to developing environmentally sustainable policies.

And yet, when you look at what the word really means, and what a truly sustainable city would look like, you realize that, 22 years later, we’re still talking about a city reconceived. It’s still — in terms of what politicians like Newsom are putting on the table — a pretty radical proposal.

Gro Harlem Brundtland, the former Norwegian prime minister, chaired a United Nations commission in 1983 that came up with what is probably the first official definition of sustainable development: "development that meets the needs of the present without compromising the ability of future generations to meet their own needs." An urban planning conference in Berlin in 2000 adopted a sustainability statement that talked about "the flow principle, that is based on an equilibrium of material and energy and also financial input/output."

The Vermont-based Institute for Sustainable Communities goes a bit further: "Sustainable communities have a strong sense of place … They are places that build on their assets and dare to be innovative." You can look on the Web and find a thousand more statements and definitions, some highly technical and some so hippy-dippy they’re painful to read.

But in the end, any real definition of a sustainable city starts with the second part of the phrase.

Cities are eternal. The world’s great metropolises have always outlived modest constructs like nations and empires. They are, as the late urbanist Jane Jacobs used to say, the building blocks of society.

But in the United States, and in much of the rest of the world, cities have become part of a globalized economic system that severs the use of products and services from their origin. Where did that burger you just ate come from? How about the lettuce at the supermarket? The clothes you wear to work? The electricity you use when you turn on your computer? Who controls the flow of money into and out of your community? Who controls the place you live, the money that comes out of the nearest ATM? What about your job — where does your paycheck come from, and where does it go?

How do those factors affect how you live — and how well you live — in San Francisco?

The thing is, you probably don’t know. And what you don’t know is hurting you.

Because a truly sustainable city isn’t just an environmental notion, and a sustainable urban policy isn’t just about planting gardens in front of City Hall. It’s about defining — and changing — the way we think about the economy, politics, business, and the local power structure.

That’s been part of the Guardian‘s mission for 42 years.

When you talk to progressive economists these days (and yeah, there are a few) and people who think about building sustainable local economies (and there are a growing number of them), they say three things:

Cities have to think about how to become more self-sufficient, how to provide locally things that we once imported, how to use local resources to create new jobs and economic activity. Those new jobs and sustainable practices are most likely to come from locally owned, independent businesses. And — particularly these days — the public sector has to play a major role.

That’s what the stories in this anniversary issue are about. A sustainable economy means encouraging start-ups and innovation, using public financing resources, and avoiding a reliance on big chains and giant corporations. A sustainable transportation and land-use policy means building neighborhoods with housing for diverse income groups and cutting down on cars and making the city a better, safer place to walk and bike. A sustainable energy policy means locally controlled renewable generation, not a monster private utility that ferries in nuclear and fossil-fuel power from out of town. Sustainable food means using community agriculture, right here in town.

It’s surprising how simple that sounds — and how politically difficult it is to implement.

See, in San Francisco — this great liberal city — policy decisions are still controlled to a stunning extent by a small group of powerful people who were never elected to anything. You can see how it looks this year by following the money chart we ran in the last issue. It showed how five downtown organizations have been raising and spending hundreds of thousands of dollars to take control of the Board of Supervisors.

Or look at Proposition H, the Clean Energy Act on the November ballot. Prop. H is a prescription for sustainable energy; the measure would not only set aggressive goals for renewables, it would shift control of the city’s energy agenda away from Pacific Gas and Electric Co. and give it to the people of San Francisco.

Big private energy companies may spend a lot of money on "green" advertising, but they never have, and never will, take the steps needed to create a sustainable system. Because that would mean undercutting their profits and limiting their growth.

A sustainable energy system would use much less electricity and import almost none. It would operate with thousands of small, distributed generation facilities, like solar panels on roofs. And power from the sun and wind is free. That doesn’t work for a giant profit-hungry utility; it works great for a community-based system.

So where is Newsom, who likes to call himself a green mayor? He’s against it. Where are the business leaders in town? Standing with PG&E. Where is the power structure? Fighting to prevent a sustainable energy future for San Francisco.

And the big chain-owned daily newspaper is right there with them.


There aren’t many locally-owned independent newspapers left in America. Even the alternative press has become chain-happy. In Boston, New York, Washington, Atlanta, Miami, Chicago, Denver, Houston, Phoenix, Los Angeles … most of the nation’s biggest cities, the once-upstart weeklies are owned by big national chains.
But in San Francisco, the paper Bruce Brugmann and Jean Dibble founded in 1966 is still the paper that Bruce Brugmann and Jean Dibble run in 2008.
The Guardian was always both a newspaper and small business. Unlike a lot of the wild and wonderful publications that flourished in San Francisco in the 1960s, the Guardian was built to last. Bruce and Jean decided from the start that this would be their life’s work — and although it was a bit dicey at times, the paper has survived and grown into one of the most influential weeklies in the country.
The Guardian was always a part of San Francisco. We believe in this city, in this community, in its life and culture and grassroots politics. We’ve always taken an active role in trying to improve the place where we live and work, and we’re proud of it.
Over the years that has meant exposing the corrupt (and secretive) gang that was trying to turn San Francisco into another Manhattan. It’s meant publishing a pioneering cost-benefit study showing that high-rise office development costs the city more in services than it generates in taxes. It’s meant funding and publishing the first major local study showing that small businesses create most of the net new jobs in San Francisco. It’s meant revealing how PG&E violates federal law and steals cheap power from San Francisco. It’s meant competing with — and writing about — the local daily newspaper monopoly. It’s meant fighting privatization, from the Presidio to City Hall, and pushing for a Sunshine Ordinance to keep the politicians honest. It’s meant siding with the neighborhoods and the artists and the tenants against what we’ve called the economic cleansing of San Francisco.
And this year, it means promoting a real vision of what a sustainable city would look like. Which is, really, what the Guardian has been about all these 42 amazing years. *

Independence day

Labels come and go. Not long ago, Moedoe and Frisco Street Show were among the most important outlets for Bay Area rap. Now both manufacture energy drinks instead: Hyphy Juice and Hunid Racks, respectively. Rap frequently favors money over artistry, but eliminating the art entirely is a bit much. To pose the Jacka’s musical question, "What happened to comin’ the dopest?"

The answer may be found at 21st and Mission streets, home of SMC Recordings.

"Rap’s a hustle because of where it’s from," 26-year-old co-owner and A&R head Will Bronson says. "I understand that, but in the end it’s still about making good music."

A shocking philosophy in today’s industry, but SMC makes it work. Not only has the company released some of the biggest recent Bay rap discs — including 2007’s Da Baydestrian by Mistah FAB and Da Bidnes by PSD, Keak, and Messy Marv — but it’s also building a national roster. Atlanta acquisitions like Pastor Troy and Killer Mike, whose current I Pledge Allegiance to the Grind 2 received critical acclaim, hitting No. 16 on Billboard’s rap chart, have raised the label’s nationwide profile.

"It’s going well," Killer Mike reports. "Major labels spend money on you, but never listen. SMC entertains every idea." This includes everything from letting Mike executive-produce his disc to approving his risky lead single, "Bang," attacking what he sees as the present lameness of Atlanta hip-hop.

"In rap it’s OK to be yourself," Bronson says. "No matter what level they’re on, the artists we sign are loved by their fans. Our records sell longer due to their quality."

SMC’s success wasn’t overnight: it evolved from late ’90s imprint UTR, whose founders included SMC co-owner Ralph Tashjian. The industry veteran long dreamed of starting a label here in his hometown. When his partners bailed, Tashjian brought in former UTR intern Bronson to continue as the Navarre-distributed Sumday Entertainment, whose successes included Keak’s Copium (2003), co-released with Moedoe, and Messy Marv’s Disobayish (2004). Switching distributors in 2005, when Bronson became a full partner, prompted another name change.

"Independent distribution is the future," Tashjian says. "Independent distributors are all successful while the majors are dying. As that began, Universal launched its own independent distribution, Fontana. We were one of their first labels. We had no obligation to Navarre, but for appearances we changed the name to SMC: Sumday Music Corp."

Such powerful distribution and an artist-friendly environment — artists own their masters, for example, which the label licenses — have helped SMC score bigger acts. It’s even invaded New York City, signing Capone-N-Noreaga for their third album. In a late-breaking development, SMC has now entered into a joint venture with the legendary Rakim, though details have yet to be announced.

Such moves, unprecedented for an independent Frisco hip-hop label, come at an interesting juncture in the Bay’s post-hyphy moment. There are cross-regional promotional opportunities; Mess, for example, is on Killer Mike’s disc, which includes an ad directing listeners to Mess’ upcoming project. Most important, as it goes national, SMC has reaffirmed its local role, partnering with Thizz Entertainment to launch two series, Town Thizzness for Oakland acts and Thizz City for SF, at the consumer-friendly price of $9.99. Town Thizzness has already released the two hands-down best local discs this year, Beeda Weeda’s Da Thizzness and J-Stalin’s Gas Nation. And the Bay isn’t confined to these series, as the upcoming San Quinn album, From a Boy to a Man, due Nov. 25, attests.

These series, Bronson says, "testify to our commitment to the Bay. We’re in SF so we need a marquee Bay Area artist. We need to develop the new Quinns, new Messy Marvs, in some way." It’s about time someone made that commitment.

Alameda County Superior Court judge, Seat 9

DENNIS HAYASHI


A public interest lawyer with a focus on civil rights, Dennis Hayashi has worked for years with the Asian Law Caucus. He was co-counsel in the historic case that challenged Fred Korematsu’s conviction for refusing to report to a Japanese internment camp during World War II. He’s run the state’s Department of Fair Employment and Housing and was a civil rights lawyer in the Clinton administration. He has spent much of his life serving the public interest and would make a fine addition to the bench.

Berkeley mayor

TOM BATES


Tom Bates was a stellar member of the State Assembly once upon a time, and is seen in many quarters as a progressive icon in the East Bay. But he’s been a bit of a disappointment at times as mayor. He’s been dragging his feet on a Berkeley sunshine ordinance, he’s way too friendly with developers, and he helped gut the landmarks-preservation law. He’s supported some terrible candidates (like Gordon Wozniak).

Still, Bates has made some strides on workforce housing and on creating green jobs. He’s fought the University of California over its development plans. And he’s far, far better than his opponent, Shirley Dean.

Dean is even more pro-development than Bates. She’s terrible on tenant issues and won’t be able to work at all with the progressives on the council. We have reservations with Bates, but he’s the better choice.

Berkeley City Council

District 2

DARRYL MOORE


Moore came to the Berkeley City Council with a great track record. We endorsed him for this post in 2004, as did the Green Party. He supports instant-runoff voting and a sunshine ordinance. But he’s been awfully close to the developers and brags that he’s proud to have a high rating from the Berkeley Chamber of Commerce. His opponent, John Crowder, isn’t a serious contender, so we’ll go with Moore, with reservations.

District 3

MAX ANDERSON


Max Anderson is one of two real progressives on the council (the other is Kriss Worthington). Anderson, an ex-Marine, was one of the leaders in the battle against Marine recruitment in Berkeley and has been strong on environmental issues, particularly the fight against spraying the light brown apple moth. He deserves another term.

District 4

JESSE ARREGUIN


Dona Spring, who ably represented District 4 and was a strong progressive voice on the council, died in July, leaving a huge gap in Berkeley politics. The best choice to replace her is Jesse Arreguin, who currently works in the office of Councilmember Kriss Worthington.

Arreguin is the chair of the Rent Stabilization Board and has served on the Zoning Appeals Board and the Downtown Area Plan Advisory Committee, where he out-organized the moderates and pro-development sorts. He supports sustainable, community-based planning and would be an excellent addition to the council

District 5

SOPHIE HAHN


This is a fairly moderate district, and incumbent Laurie Capitelli is the clear favorite. But Capitelli has been terrible on development issues and is too willing to go along with the mayor on land use. Sophie Hahn, a lawyer, is a bit cautious (she didn’t like the city’s involvement in the Marine recruitment center battle), but she’s a strong environmentalist who’s pushing a more aggressive bicycle policy. And she’s a big supporter of local small businesses and wants to promote a "shop local" program in Berkeley. She’s the better choice.

District 6

PHOEBE ANN SORGEN


Incumbent Betty Olds — one of the most conservative members of the city council — is retiring, and she’s endorsed her council aide, Susan Wengraf, for the seat. It’s not a district that tends to elect progressives, and Wengraf, former president of the moderate (and often pro-landlord) Berkeley Democratic Club, is the odds-on favorite.

We’re supporting Phoebe Ann Sorgen, who is probably more progressive than the district and lacks experience in city politics but who is solid on the issues. A member of the Peace and Justice Commission and the KPFA board, she’s pushing alternative-fuel shuttles between the neighborhoods and is, like Sophie Hahn, a proponent of shop-local policies.

Berkeley School Board

Incumbent John Selawsky has, by almost every account and by almost any standard, done a great job on the school board. He’s mixed progressive politics with fiscal discipline and helped pull the district out of a financial mess a few years back. He knows how to work with administrators, teachers, and neighbors. He richly deserves another term.

The Berkeley left doesn’t always agree on everything, but there’s a pretty strong consensus in favor of this five-member slate for the Berkeley Rent Board. The five were nominated at an open convention, all have pledged to support tenant rights, and they will keep the board from losing it’s generally progressive slant.

REBECCA KAPLAN


Rebecca Kaplan, an AC Transit Board member, came in first in the June primary for this seat, well ahead of Kerry Hamill, but she fell short of 50 percent, so the two are in a runoff.

Hamill is the candidate of state Sen.(and East Bay kingmaker) Don Perata. Political committees with links to Perata have poured tens of thousands of dollars into a pro-Hamill campaign, and city council member Ignacio de la Fuente, a Perata ally, is raising money for Hamill too.

Kaplan is independent of the Perata political machine. She’s an energetic progressive with lots of good ideas — and a proven track record in office. While on the AC Transit Board, Kaplan pushed for free bus passes for low-income youths. When she decided she wanted the district to offer all-night transit service from San Francisco, she found a way to work with both her own board and the San Francisco Board of Supervisors to iron out the jurisdiction issues and get it done. Her platform calls for affordable housing, rational development, and effective community policing. She’s exactly the kind of candidate Oakland needs, and we’re happy to endorse her.

CHRIS PEEPLES


Chris Peeples was appointed to an open seat in 1997, elected in 1998, and reelected in 2000 and 2004. A longtime advocate for public transit, and AC Transit bus service in particular, Peeples is a widely respected board member who helped secure free transit for lower-income youths and the current low-cost youth passes. Involved in the AC Bus Riders Union, Alliance for AC Transit, Regional Alliance for Transit, Alliance for Sensible Transit, Coalition for a One-Stop Terminal, and many other transit groups, Peeples has served on the Oakland Ethics Commission and is active in the meetings of the Transportation Research Board and the American Public Transportation Association.

Peeples was also involved in the mess that was the Van Hool bus contract, in which AC Transit bought buses from a Belgian company that were poorly designed and had to be changed. Joyce Roy, who is well known in the East Bay for her lawsuit against the Oak to Ninth proposed development and her participation in the ensuing referendum effort, is challenging Peeples because of his support of the Van Hool buses. A retired architect and local public transit advocate, Roy lost the 2004 race for the AC Transit Board, Ward 2, post to current incumbent Greg Harper. But now she is running a stronger race because she has the support of the drivers and passengers, especially the seniors and the disabled, who find these buses uncomfortable and unsafe.

But given Peeples’s long history and generally good record, we’ll endorse him for another term.

An East Bay attorney and former Emeryville mayor, Greg Harper was elected in November 2000 and reelected in 2004 to represent Ward 2. Harper appears committed to ridership growth and has become increasingly critical of the district’s attempts to increase fares, not to mention the much maligned decision to purchase Van Hool buses. Harper is in favor of Bus Rapid Transit (BRT) and has a strong record of listening and being responsive to community concerns. He has said that if Berkeley votes to stop BRT-dedicated lanes, he’d only try to implement BRT in his district, if its makes sense.

East Bay Municipal Utility District

With the East Bay falling short of targeted water savings, it’s increasingly vital that voters elect environmentally conscious EBMUD directors. Doug Linney fits the bill. First elected in 2002 and reelected in 2004, Linney is a solid progressive. Opposed to reservoir expansion, Linney wants to promote water conservation and is open to groundwater storage and water transfers, but only if no environmental damage is done.

Incumbent William Patterson has supported dam and reservoir expansion, groundwater storage, wastewater recycling, and desalinization. He has opposed large water transfers from agricultural districts and rate changes that would promote conservation.

His opponent, Bob Feinbaum, is a solid environmentalist who supports water transfers, opposes desalinization and reservoir expansion, and offers promising and sustainable ideas in terms of managing the drought that include setting fair rates for big users and protecting low-income users. He deserves support.

Library bonds

Measure FF would authorize $26 million in bonds to improve and bring up to code branch libraries in a city where the branches get heavy use and are a crucial part of the neighborhoods. Vote yes.

A proposed tiny tax on improvements in residential and commercial property would fund emergency medical response and disaster preparedness. Vote yes.

Park taxes

A legal technicality, Measure HH allows the city to raise the limit on spending so it can allocate taxes that have already been approved to pay for parks, libraries, and other key services.

Berkeley Measure II

Redistricting schedule

YES


This noncontroversial measure would give the city an additional year after the decennial census is completed to finish work on drawing new council districts. After the 2000 census, which undercounted urban populations, Berkeley (and other cities) had to fight to get the numbers adjusted, and that pushed the city up against a statutory limit for redistricting. Measure II would allow a bit more flexibility if, once again, the census numbers are hinky.

Medical marijuana zoning

YES


Berkeley law allows for only three medical marijuana clinics, and this wouldn’t change that limit. But Measure JJ would make pot clinics a defined and permitted use under local zoning laws. Since it’s hard — sometimes almost impossible — to find a site for a pot club now, this measure would allow existing clinics to stay in business if they have to move. Vote yes.

Berkeley Measure KK

Repealing bus-only lanes

NO


Yes, there are problems with the bus-only lanes in Berkeley (they don’t connect to the ferries, for example), but the idea is right. Measure KK would mandate voter approval of all new transit lanes; that’s crazy and would make it much harder for the city to create what most planners agree are essential new modes of public transit. Vote no.

Landmarks preservation

Developers in Berkeley (and, sad to say, Mayor Tom Bates) see the Landmarks Preservation Commission as an obstacle to development, and they want to limit its powers. This is a referendum on the mayor’s new rules; if you vote no, you preserve the ability of the landmarks board to protect property from development.

Oakland Measure N

School tax

This is a parcel tax to fund Oakland public schools. San Francisco just passed a similar measure, aimed at providing better pay for teachers. Parcel taxes aren’t the most progressive money source — people who own modest homes pay the same per parcel as the owners of posh commercial buildings — but given the lack of funding choices in California today, Measure N is a decent way to pay for better school programs. Vote yes.

Children and youth services

This is a set-aside to fund children and youth services. We’re always wary about set-asides, but kids are a special case: children can’t vote, and services for young people are often tossed aside in the budget process. San Francisco’s version of this law has worked well. Vote yes.

ALAMEDA COUNTY MEASURES

Measure VV

AC Transit parcel tax

YES


In face of rising fuel costs and cuts in state funding, AC Transit wants to increase local funding to avoid fare increases and service cuts. Measure VV seeks to authorize an annual special parcel tax of $96 per year for 10 years, starting in 2009.

The money is intended for the operation and maintenance of the bus service. Two-thirds voter approval is needed. If passed, a community oversight committee would monitor how the money is being spent.

The measure has the support of the Sierra Club’s San Francisco Bay Chapter and the League of Women Voters.

Measure WW

Extension of existing East Bay Park District bond

YES


The East Bay Regional Park District operates 65 regional parks and more than a thousand miles of trails. It’s an amazing system and a wonderful resource for local residents. But the district needs ongoing sources of money to keep this system in good shape. Measure WW would reauthorize an existing East Bay Park District bond. This means that the owner of a $500,000 home would continue to pay $50 a year for the next 20 years.

One quarter of the monies raised would go to cities, special park and recreation districts, and county service areas. The remaining 75 percent would go toward park acquisitions and capital projects. The bonds constitute a moderate burden on property owners but seem like a small price to ensure access to open space for people of all economic backgrounds. Vote yes.

SAN FRANCISCO MEASURES

Proposition A

San Francisco General Hospital bonds

YES, YES, YES


This critically needed $887 million bond would be used to rebuild the San Francisco General Hospital and Trauma Center, which is currently not up to seismic safety codes. If the hospital isn’t brought into seismic compliance by 2013, the state has threatened to shut it down.

Proposition A has the support of just about everyone in town: Sen. Dianne Feinstein, Rep. Nancy Pelosi, all four state legislators from San Francisco, Mayor Gavin Newsom, former mayors Willie Brown and Frank Jordan, all 11 supervisors, the San Francisco Chamber of Commerce, Service Employees International Union, Local 1021 … the list goes on and on.

And for good reason: SF General is not only the hospital of last resort for many San Franciscans and the linchpin of the entire Healthy San Francisco system. It’s also the only trauma center in the area. Without SF General, trauma patients would have to travel to Palo Alto for the nearest available facility.

Just about the only opposition is coming from the Coalition for Better Housing. This deep-pocketed landlord group is threatening to sink the hospital bond unless it gets concessions on Sup. Michela Alioto-Pier’s legislation that would allow landlords to pass the costs of the $4 billion rebuild of the city’s Hetch Hetchy water, sewage, and power system through to their tenants.

These deplorable tactics should make voters, most of whom are tenants, even more determined to see Prop. A pass. Vote yes.

Proposition B

Affordable housing fund

YES, YES, YES


Housing isn’t just the most contentious issue in San Francisco; it’s the defining issue, the one that will determine whether the city of tomorrow bears any resemblance to the city of today.

San Francisco is on the brink of becoming a city of the rich and only the rich, a bedroom community for Silicon Valley and an urban nest for wealthy retirees. Some 90 percent of current city residents can’t afford the cost of a median-priced house, and working-class people are getting displaced by the day. Tenants are thrown out when their rent-controlled apartments are converted to condos. Young families find they can’t rent or buy a place with enough room for kids and are forced to move to the far suburbs. Seniors and people on fixed incomes find there are virtually no housing choices for them in the market, and many wind up on the streets. Small businesses suffer because their employees can’t afford to live here; the environment suffers because so many San Francisco workers must commute long distances to find affordable housing.

And meanwhile, the city continues to allow developers to build million-dollar condos for the rich.

Proposition B alone won’t solve the problem, but it would be a major first step. The measure would set aside a small percentage of the city’s property-tax revenue — enough to generate about $33 million a year — for affordable housing. It would set a baseline appropriation to defend the money the city currently spends on housing. It would expire in 15 years.

Given the state of the city’s housing crisis, $33 million is a fairly modest sum — but with a guaranteed funding stream, the city can seek matching federal and state funds and leverage that over 15 years into billions of dollars to build housing for everyone from very low-income people to middle-class families.

Prop. B doesn’t raise taxes, and if the two revenue measures on the ballot, Propositions N and Q, pass, there will be more than enough money to fund it without any impact on city services.

The mayor and some other conservative critics say that set-asides such as this one cripple the ability of elected officials to make tough budget choices. But money for affordable housing isn’t a choice anymore in San Francisco; it’s a necessity. If the city can’t take dramatic steps to retain its lower-income and working-class residents, the city as we know it will cease to exist. A city of the rich is not only an appalling concept; it’s simply unsustainable.

The private market alone can’t solve San Francisco’s housing crisis. Vote yes on B.

Proposition C

Ban city employees from commissions

NO


Proposition C would prohibit city employees from serving on boards and commissions. Sponsored by Sup. Jake McGoldrick, it seems to make logical sense — why should a city department head, for example, sit on a policy panel that oversees city departments?

But the flaw in Prop. C is that it excludes all city employees, not just senior managers. We see no reason why, for example, a frontline city gardener or nurse should be barred from ever serving on a board or commission. We’re opposing this now, but we urge the supervisors to come back with a new version that applies only to employees who are exempt from civil service — that is, managers and political appointees.

Proposition D

Financing Pier 70 waterfront district

YES


Pier 70 was once the launching pad for America’s imperial ambitions in the Pacific, but it’s sadly fallen into disrepair, like most Port of San Francisco property. The site’s historic significance and potential for economic development (think Monterey’s Cannery Row) have led port officials and all 11 members of the Board of Supervisors to put forward this proposal to prime the pump with a public infrastructure investment that would be paid back with interest.

The measure would authorize the Board of Supervisors to enter into long-term leases consistent with the forthcoming land use and fiscal plans for the site, and to front the money for development of roads and waterfront parks, refurbishing Union Iron Works, and other infrastructure work, all of which would be paid back through tax revenue generated by development of the dormant site. It’s a good deal. Vote yes.

Proposition E

Recall reform

YES


The recall is an important tool that dates back to the state’s progressive era, but San Francisco’s low signature threshold for removing an officeholder makes it subject to abuse. That’s why the Guardian called for this reform ("Reform the Recall," 6/13/07) last year when downtown interests were funding simultaneous recall efforts (promoted by single-issue interest groups) against three progressive supervisors: Jake McGoldrick, Aaron Peskin, and Chris Daly. The efforts weren’t successful, but they diverted time and energy away from the important work of running the city.

This measure would bring the City Charter into conformity with state law, raising the signature threshold from 10 percent of registered voters to 20 percent in most supervisorial districts, and leaving it at 10 percent for citywide office. The sliding-scale state standard is what most California counties use, offering citizens a way to remove unaccountable representatives without letting a fringe-group recall be used as an extortive threat against elected officials who make difficult decisions that don’t please everyone.

Proposition F

Mayoral election in even-numbered years

YES


This one’s a close call, and there are good arguments on both sides. Sponsored by Sup. Jake McGoldrick, Proposition F would move mayoral elections to the same year as presidential elections. The pros: Increased turnout, which tends to favor progressive candidates, and some savings to the city from the elimination of an off-year election. The cons: The mayor’s race might be eclipsed by the presidential campaigns. In a city where the major daily paper and TV stations have a hard time covering local elections in the best of times, the public could miss out on any real scrutiny of mayoral candidates.

Here’s what convinced us: San Francisco hasn’t elected a true progressive mayor in decades. The system we have isn’t working; it’s worth trying something else.

Proposition G

Retirement system credit for unpaid parental leave

YES


Proposition G brings equity to city employees who started families before July 1, 2003. Currently this group is unable to benefit from a 2002 charter amendment that provides city employees with paid parental leave. Prop. G gives these parents the opportunity to buy back unpaid parental leave and earn retirement credits for that period.

Critics charge that Prop. G changes the underlying premise of the city’s retirement plan and that this attempt to cure a perceived disparity creates a precedent whereby voters could be asked to remedy disparities anytime benefit changes are made. They claim that there are no guarantees Prop. G won’t end up costing the taxpayers money.

But Prop. G, which is supported by the San Francisco Democratic and Republican Parties, the Chamber of Commerce, SEIU Local 1021, the Police Officers Association, and San Francisco Firefighters 798, simply allows city workers to buy back at their own expense some of their missed retirement benefits, thereby creating a fiscally responsible solution to an oversight in the 2003 charter amendment.

Proposition H

Clean Energy Act

YES, YES, YES


Proposition H is long, long overdue. This charter amendment would require the city to study how to efficiently and affordably achieve 51 percent renewable energy by 2017, scaled up to 100 percent by 2040. Should the study find that a publicly owned utility infrastructure would be most effective, it would allow the San Francisco Public Utilities Commission (SFPUC) to issue revenue bonds, with approval from the Board of Supervisors, to purchase the necessary lines, poles, and power-generation facilities. The measure includes a green jobs initiative and safeguards benefits and retirement packages for employees who leave Pacific Gas and Electric Co. to work for the SFPUC.

PG&E hates this because it could put the giant private company out of business in San Francisco, and the company has already spent millions of dollars spreading false information about the measure. PG&E says the proposal would cost $4 billion and raise electric bills by $400 a year for residents, but there’s no verifiable proof that these figures are accurate. An analysis done by the Guardian (see "Cleaner and Cheaper," 9/10/08) shows that rates could actually be reduced and the city would still generate excess revenue.

PG&E has also spun issuing revenue bonds without a vote of the people as a bad thing — it’s not. Other city departments already issue revenue bonds without a vote. The solvency of revenue bonds is based on a guaranteed revenue stream — that is, the city would pay back the bonds with the money it makes selling electricity. There’s no cost and no risk to the taxpayers. In fact, unless the city can prove that enough money would be generated to cover the cost of the bond plus interest, the bond won’t fly with investors.

At a time when utility companies are clinging to old technologies or hoping for pie-in-the-sky solutions like "clean coal," this measure is desperately needed and would set a precedent for the country. Environmental leaders like Bill McKibben and Van Jones, who both endorsed the bill, are watching San Francisco closely on this. Prop. H has been endorsed by 8 of the 11 supervisors, Assemblymembers Mark Leno and Fiona Ma, state senator Carole Migden, the Democratic Party, the Green Party, SEIU Local 1021, the Sierra Club, Senior Action Network, the Harvey Milk LGBT Democratic Club, the Alice B. Toklas LGBT Democratic Club, and the San Francisco Tenants Union, among many others.

The bulk of the opposition comes from PG&E, which is entirely funding the No on H campaign and paid for 22 of 30 ballot arguments against it. The company also has given money, in one way or another, to all the public officials who oppose this measure, including Mayor Gavin Newsom, Sen. Dianne Feinstein, and Sups. Michela Alioto-Pier, Carmen Chu, and Sean Elsbernd.

Prop. H pits a utility that can’t meet the state’s modest renewable-energy goals and runs a nuclear power plant against every environmental group and leader in town. Vote yes.

Proposition I

Independent ratepayer advocate

NO


At face value, this measure isn’t bad, but it’s superfluous. It’s a charter amendment that would establish an independent ratepayer advocate, appointed by the city administrator and tasked with advising the SFPUC on all things related to utility rates and revenue. Passing Prop. H would do that too.

Proposition I was put on the ballot by Sup. Michela Alioto-Pier as a way to save face after her ardent opposition to the city’s plan to build two peaker power plants, in which she made impassioned pleas for more renewable energy and more energy oversight. (She opposes Prop. H, which would create both.) During the debate over the peaker power plants, Alioto-Pier introduced a variety of bills, including this one. There isn’t any visible campaign or opposition to it, but there’s no need for it. Vote yes on H, and no on I.

Proposition J

Historic preservation commission

YES


There’s something in this measure for everyone to like, both the developers who seek to alter historic buildings and the preservationists who often oppose them. It adopts the best practices of other major US cities and updates 40-year-old rules that govern the Landmark Preservation Advisory Board.

Proposition J, sponsored by Sup. Aaron Peskin, would replace that nine-member board with a seven-member commission that would have a bit more authority and whose members would be preservation experts appointed by the mayor, approved by the board, and serving fixed terms to avoid political pressures. It would set review standards that vary by project type, allowing streamlined staff-level approval for small projects and direct appeals to the Board of Supervisors for big, controversial proposals.

This was a collaborative proposal with buy-in from all stakeholders, and it’s formally opposed only by the Small Property Owners of San Francisco, an extremist property rights group. Vote yes.

Proposition K

Decriminalizing sex work

YES


We’re not big fans of vice laws; generally speaking, we’ve always believed that drugs, gambling, and prostitution ought to be legalized, tightly regulated, and heavily taxed. Proposition K doesn’t go that far — all it does is make enforcement of the prostitution laws a low priority for the San Francisco Police Department. It would effectively cut off funding for prostitution busts — but would require the cops to pursue cases involving violent crime against sex workers.

The opponents of this measure talk about women who are coerced into sex work, particularly immigrants who are smuggled into the country and forced into the trade. That’s a serious problem in San Francisco. But the sex workers who put this measure on the ballot argue that taking the profession out of the shadows would actually help the police crack down on sex trafficking.

In fact, a significant part of the crime problem created by sex work involves crimes against the workers — violent and abusive pimps, atrocious working conditions, thefts and beatings by johns who face no consequences because the sex workers face arrest if they go to the police.

The current system clearly isn’t working. Vote yes on K.

Proposition L

Funding the Community Justice Center

NO


This measure is an unnecessary and wasteful political gimmick by Mayor Newsom and his downtown allies. Newsom has long pushed the Community Justice Center (CJC) as a panacea for quality-of-life crimes in the Tenderloin and surrounding areas, where the new court would ostensibly offer defendants immediate access to social service programs in lieu of incarceration. Some members of the Board of Supervisors resisted the idea, noting that it singles out poor people and that the services it purports to offer have been decimated by budget shortfalls. Nonetheless, after restoring deep cuts in services proposed by the mayor, the board decided to go ahead and fund the CJC.

But the mayor needed an issue to grandstand on this election, so he placed this measure on the ballot. All Proposition L would do is fund the center at $2.75 million for its first year of operations, rather than the approved $2.62 million. We’d prefer to see all that money go to social services rather than an unnecessary new courtroom, but it doesn’t — the court is already funded. In the meantime, Prop. L would lock in CJC program details and prevent problems from being fixed by administrators or supervisors once the program is up and running. Even if you like the CJC, there’s no reason to make it inflexible simply so Newsom can keep ownership of it. Vote no.

Proposition M

Tenants’ rights

YES


Proposition M would amend the city’s rent-control law to prohibit landlords from harassing tenants. It would allow tenants to seek rent reductions if they’re being harassed.

Proponents — including the SF Tenants Union, the Housing Rights Committee, St. Peter’s Housing Committee, the Community Tenants Association, the Affordable Housing Alliance, the Eviction Defense Collaborative, and the Tenderloin Housing Clinic — argue that affordable, rent-controlled housing is being lost because landlords are allowed to drive long-term tenants from their rent-controlled homes. Citing the antics of one of San Francisco’s biggest landlords, CitiApartments, the tenant activists complain about repeated invasions of privacy, constant buyout offers, and baseless bogus eviction notices.

Because no language currently exists in the rent ordinance to define and protect tenants from harassment, landlords with well-documented histories of abuse have been able to act with impunity. Vote Yes on M.

Proposition N

Real property transfer tax

YES, YES, YES


Prop. N is one of a pair of measures designed to close loopholes in the city tax code and bring some badly needed new revenue into San Francisco’s coffers. The proposal, by Sup. Aaron Peskin, would increase to 1.5 percent the transfer tax on the sale of property worth more than $5 million. It would generate about $30 million a year.

Prop. N would mostly affect large commercial property sales; although San Francisco housing is expensive, very few homes sell for $5 million (and the people buying and selling the handful of ultra-luxury residences can well afford the extra tax). It’s a progressive tax — the impact will fall overwhelmingly on very wealthy people and big business — and this change is long overdue. Vote yes.

Proposition O

Emergency response fee

YES, YES, YES


With dozens of state and local measures on the ballot this year, Proposition O is not getting much notice — but it’s a big deal. If it doesn’t pass, the city could lose more than $80 million a year. With the economy tanking and the city already running structural deficits and cutting essential services, that kind of hit to the budget would be catastrophic. That’s why the mayor, all 11 supervisors, and both the Republican and Democratic Parties support Prop. O.

The text of the measure is confusing and difficult to penetrate because it deals mainly with legal semantics. It’s on the ballot because of arcane legal issues that might make it hard for the city to enforce an existing fee in the future.

But here’s the bottom line: Prop. O would not raise taxes or increase the fees most people already pay. It would simply replace what was a modest "fee" of a couple of bucks a month to fund 911 services with an identical "tax" for the same amount, while also updating the technical definition of what constitutes a phone line from a now defunct 1970s-era statute. The only people who might wind up paying any new costs are commercial users of voice-over-internet services.

It’s very simple. If Prop. O passes, the vast majority of us won’t pay anything extra and the city won’t have to make $80 to $85 million more in cuts to things like health care, crime prevention, and street maintenance. That sounds like a pretty good deal to us. Vote yes.

Proposition P

Transportation Authority changes

NO, NO, NO


Mayor Gavin Newsom is hoping voters will be fooled by his argument that Proposition P, which would change the size and composition of the San Francisco County Transportation Authority, would lead to more efficiency and accountability.

But as Prop. P’s opponents — including all 11 supervisors, the San Francisco Planning and Urban Research Association, and the Sierra Club — point out, the measure would put billions of taxpayer dollars in the hands of political appointees, thus removing independent oversight of local transportation projects.

The Board of Supervisors, which currently serves as the governing body of the small but powerful, voter-created Transportation Authority, has done a good job of acting as a watchdog for local sales-tax revenues earmarked for transportation projects and administering state and federal transportation funding for new projects. The way things stand, the mayor effectively controls Muni, and the board effectively controls the Transportation Authority, providing a tried and tested system of checks and balances that gives all 11 districts equal representation. There is no good reason to upset this apple cart. Vote No on P.

Proposition Q

Modifying the payroll tax

YES, YES, YES


Proposition Q would close a major loophole that allows big law firms, architecture firms, medical partnerships, and other lucrative outfits to avoid paying the city’s main business tax. San Francisco collects money from businesses largely through a 1.5 percent tax on payroll. It’s not a perfect system, and we’d like to see a more progressive tax (why should big and small companies pay the same percentage tax?). But even the current system has a giant problem that costs the city millions of dollars a year.

The law applies to the money companies pay their employees. But in a fair number of professional operations, the highest-paid people are considered "partners" and their income is considered profit-sharing, not pay. So the city’s biggest law firms, where partners take home hundreds of thousands of dollars a year in compensation, pay no city tax on that money.

Prop. Q would close that loophole and treat partnership income as taxable payroll. It would also exempt small businesses (with payrolls of less than $250,000 a year) from any tax at all.

The proposal would bring at least $10 million a year into the city and stop certain types of businesses from ducking their share of the tax burden. Vote yes.

Proposition R

Naming sewage plant after Bush

NO


This one has tremendous emotional and humor appeal. It would officially rename the Oceanside Water Pollution Control Plant the George W. Bush Sewage Plant. That would put San Francisco in the position of creating the first official memorial to the worst president of our time — and his name would be on a sewage plant.

The problem — not to be killjoys — is that sewage treatment is actually a pretty important environmental concern, and the Oceanside plant is a pretty good sewage treatment plant. It’s insulting to the plant, and the people who work there, to put the name of an environmental villain on the door.

Let’s name something awful after Bush. Vote no on Prop. R.

Proposition S

Budget set-aside policy

NO


This measure is yet another meaningless gimmick that has more to do with Mayor Newsom’s political ambitions than good governance.

For the record, we generally don’t like budget set-aside measures, which can unnecessarily encumber financial planning and restrict elected officials from setting budget priorities. But in this no-new-taxes political era, set-asides are sometimes the only way to guarantee that important priorities get funding from the static revenue pool. Newsom agrees — and has supported set-asides for schools, libraries, and other popular priorities.

Now he claims to want to rein that in, although all this measure would do is state whether a proposal identifies a funding source or violates a couple of other unenforceable standards. Vote no.

Proposition T

Free and low-cost substance abuse treatment

YES


Proposition T would require the Department of Public Health (DPH) to make medical and residential substance abuse treatment available for low-income and homeless people who request it. DPH already offers treatment and does it well, but there’s a wait list 500 people long — and when addicts finally admit they need help and show up for treatment, the last thing the city should do is send them away and make them wait.

Prop. T would expand the program to fill that unmet need. The controller estimates an annual cost to the General Fund of $7 million to $13 million, but proponents say the upfront cost would lead to significant savings later. For every dollar spent on treatment, the city saves as much as $13 because clinical treatment for addictive disorders is cheaper than visits to the emergency room, where many low-income and homeless people end up when their untreated problems reach critical levels.

This ordinance was put on the ballot by Sups. Daly, McGoldrick, Mirkarimi, and Peskin, and has no visible opposition, although some proponents frame it as a way to achieve what the Community Justice Center only promises. Vote yes.

Proposition U

Defunding the Iraq War

YES


Proposition U is a declaration of policy designed to send a message to the city’s congressional representatives that San Francisco disproves of any further funding of the war in Iraq, excepting whatever money is required to bring the troops home safely.

The progressive block of supervisors put this on the ballot, and according to their proponent argument in the Voter Information Pamphlet, the Iraq War has cost California $68 billion and San Francisco $1.8 billion. The Republican Party is the lone voice against this measure. Vote yes.

Proposition V

Bringing back JROTC

NO, NO, NO


The San Francisco school board last year voted to end its Junior Reserve Officers’ Training Corps program, which was the right move. A military-recruitment program — and make no mistake, that’s exactly what JROTC is — has no place in the San Francisco public schools. The board could have done a better job finding a replacement program, but there are plenty of options out there.

In the meantime, a group of JROTC backers placed Proposition V on the ballot.

The measure would have no legal authority; it would just be a statement of policy. Supporters say they hope it will pressure the school board to restore the program. In reality, this is a downtown- and Republican-led effort to hurt progressive candidates in swing districts where JROTC might be popular. Vote no.

District 1

ERIC MAR


The incumbent District 1 supervisor, Jake McGoldrick, likes to joke that he holds his seat only because Eric Mar’s house burned down eight years ago. Back then Mar, who has had a stellar career on the school board, decided to wait before seeking higher office.

But now McGoldrick — overall a good supervisor who was wrong on a few key votes — is termed out, and progressive San Francisco is pretty much unanimous in supporting Mar as his successor.

Mar, a soft-spoken San Francisco State University teacher, was a strong critic of former school superintendent Arlene Ackerman and a leader in the battle to get the somewhat dictatorial and autocratic administrator out of the district. He’s been a key part of the progressive majority that’s made substantial progress in improving the San Francisco public schools.

He’s a perfect candidate for District 1. He has strong ties to the district and its heavily Asian population. He’s a sensible progressive with solid stands on the key issues and a proven ability to get things done. He supports the affordable housing measure, Proposition B; the Clean Energy Act, Proposition H; and the major new revenue measures. He’s sensitive to tenant issues, understands the need for a profound new approach to affordable housing, and wants to solve the city’s structural budget problems with new revenue, not just cuts.

His chief opponent, Sue Lee, who works for the Chamber of Commerce, doesn’t support Prop. H and won’t even commit to supporting district elections. She ducked a lot of our questions and was either intentionally vague or really has no idea what she would do as a supervisor. She’s no choice for the district, and we found no other credible candidates worthy of our endorsement. Vote for Eric Mar.

The danger in this district is Joe Alioto. He’s smooth, he’s slick, he’s well funded — and he would be a disaster for San Francisco. Make no mistake about it, Alioto is the candidate of downtown — and thanks to his famous name and wads of big-business cash, he’s a serious contender.

Two progressive candidates have a chance at winning this seat and keeping Alioto off the board. David Chiu is a member of the Small Business Commission (SBC) and the Democratic County Central Committee (DCCC) and is a former civil rights lawyer who now manages a company that sells campaign software. Denise McCarthy ran the Telegraph Hill Neighborhood Center for 25 years and spent 7 years on the Port Commission.

Tony Gantner, a retired lawyer, is also in the race, although he is running well behind the others in the polls.

We have concerns about all the candidates. Chiu has a solid progressive record as a commissioner and committee member: He was one of only two SBC members who supported the living-wage ordinance and Sup. Tom Ammiano’s city health care plan. He backed Sup. Aaron Peskin, his political mentor, for chair of the DCCC. He backs Prop. H, supports the two revenue measures and the affordable-housing fund, and wants to give local small businesses a leg up in winning city contracts. He has some creative ideas about housing, including a community stabilization fee on new development.

He’s also a partner in a company that received $143,000 last year from PG&E and that has worked with Republicans and some nasty business interests.

Chiu says he doesn’t get to call all the shots at Grassroots Enterprises, which he cofounded. He describes the firm as a software-licensing operation, which isn’t exactly true — the company’s own Web site brags about its ability to offer broad-based political consulting and communication services.

But Chiu vowed to resign from the company if elected, and given his strong record on progressive issues, we’re willing to take a chance on him.

McCarthy has a long history in the neighborhood, and we like her community perspective. She supports Prop. H and the affordable-housing measure. She’s a little weak on key issues like the city budget — she told us she "hadn’t been fully briefed," although the budget is a public document and the debate over closing a massive structural deficit ought to be a central part of any supervisorial campaign. And while she said there "have to be some new taxes," she was very vague on where new revenue would come from and what specifically she would be willing to cut. She supported Gavin Newsom for mayor in 2003 and told us she doesn’t think that was a bad decision. It was. But she has by far the strongest community ties of any candidate in District 3. She’s accessible (even listing her home phone number in her campaign material), and after her years on the Port Commission, she understands land-use issues.

Gantner has been a supporter of the Clean Energy Act from the start and showed up for the early organizing meetings. He has the support of the Sierra Club and San Francisco Tomorrow and talks a lot about neighborhood beatification. But we’re a little nervous about his law-and-order positions, particularly his desire to crack down on fairs and festivals and his strong insistence that club promoters are responsible for all the problems on the streets.

But in the end, Chiu, McCarthy, and Gantner are all acceptable candidates, and Joe Alioto is not. Fill your slate with these three.

District 4

DAVE FERGUSON


What a mess.

We acknowledge that this is one of the more conservative districts in the city. But the incumbent, Carmen Chu, and her main opponent, Ron Dudum, are terrible disappointments.

It’s possible to be a principled conservative in San Francisco and still win progressive respect. We often disagreed over the years with Quentin Kopp, the former supervisor, state senator, and judge, but we never doubted his independence, sincerity, or political skills. Sean Elsbernd, who represents District 7, is wrong on most of the key issues, but he presents intelligent arguments, is willing to listen, and isn’t simply a blind loyalist of the mayor.

Chu has none of those redeeming qualities. She ducks questions, waffles on issues, and shows that she’s willing to do whatever the powerful interests want. When PG&E needed a front person to carry the torch against the Clean Energy Act, Chu was all too willing: she gave the corrupt utility permission to use her name and face on campaign flyers, signed on to a statement written by PG&E’s political flak, and permanently disgraced herself. She says that most of the problems in the city budget should be addressed with cuts, particularly cuts in public health and public works, but she was unable to offer any specifics. She refused to support the measure increasing the transfer tax on property sales of more than $5 million, saying that she didn’t want to create "a disincentive to those sales taking place." We asked her if she had ever disagreed with Newsom, who appointed her, and she could point to only two examples: she opposed his efforts to limit cigarette sales in pharmacies, and she opposed Saturday road closures in Golden Gate Park. In other words, the only times she doesn’t march in lockstep with the mayor is when Newsom actually does something somewhat progressive. We can’t possibly endorse her.

Dudum, who ran a small business and tried for this office two years ago, continues to baffle us. He won’t take a position on anything. Actually, that’s not true — he’s opposed to the Clean Energy Act. Other than that, it’s impossible to figure out where he stands on anything or what he would do to address any of the city’s problems. (An example: When we asked him what to do about the illegal second units that have proliferated in the district, he said he’d solve the problem in two years. How? He couldn’t say.) We like Dudum’s small-business sentiments and his independence, but until he’s willing to take some stands and offer some solutions, we can’t support him.

Which leaves Dave Ferguson.

Ferguson is a public school teacher with little political experience. He’s a landlord, and not terribly good on tenant issues (he said he supported rent control when he was a renter, but now that he owns a four-unit building, he’s changed his mind). But he supports Prop. H, supports Prop. B, supports the revenue measures, and has a neighborhood sensibility. Ferguson is a long shot, but he’s the only candidate who made anything approaching a case for our endorsement.

District 5

ROSS MIRKARIMI


Mirkarimi won this seat four years ago after a heated race in a crowded field, and he’s quickly emerged as one of the city’s most promising progressive leaders. He understands that a district supervisor needs to take on tough citywide issues (he’s the lead author of the Clean Energy Act and won a surprisingly tough battle to ban plastic bags in big supermarkets) as well as dealing with neighborhood concerns. Mirkarimi helped soften a terrible plan for developing the old UC Extension site and fought hard to save John Swett School from closure.

But the area in which he’s most distinguished himself is preventing violent crime — something progressives have traditionally had trouble with. Four years ago, District 5 was plagued with terrible violence: murders took place with impunity, the police seemed unable to respond, and the African American community was both furious and terrified. Mirkarimi took the problem on with energy and creativity, demanding (and winning, despite mayoral vetoes) police foot patrols and community policing. Thanks to his leadership, violent crime is down significantly in the district — and the left in San Francisco has started to develop a progressive agenda for the crime problem.

He has no serious opposition, and richly deserves reelection.

District 7

SEAN ELSBERND


We rarely see eye to eye with the District 7 incumbent. He’s on the wrong side of most of the key votes on the board. He’s opposing the affordable housing measure, Prop. B. He’s opposed to the Clean Energy Act, Prop. H. It’s annoying to see someone who presents himself as a neighborhood supervisor siding with PG&E and downtown over and over again.

But Elsbernd is smart and consistent. He’s a fiscal conservative with enough integrity that he isn’t always a call-up vote for the mayor. He’s accessible to his constituents and willing to engage with people who disagree with him. The progressives on the board don’t like the way he votes — but they respect his intelligence and credibility.

Unlike many of the candidates this year, Elsbernd seems to understand the basic structural problem with the city budget, and he realizes that the deficit can’t be reduced just with spending cuts. He’s never going to be a progressive vote, but this conservative district could do worse.

District 9

The race to succeed Tom Ammiano, who served this district with distinction and is now headed for the State Legislature, is a case study in the advantages of district elections and ranked-choice voting. Three strong progressive candidates are running, and the Mission–Bernal Heights area would be well served by any of them. So far, the candidates have behaved well, mostly talking about their own strengths and not trashing their opponents.

The choice was tough for us — we like David Campos, Eric Quezada, and Mark Sanchez, and we’d be pleased to see any of them in City Hall. It’s the kind of problem we wish other districts faced: District 9 will almost certainly wind up with one of these three stellar candidates. All three are Latinos with a strong commitment to immigrant rights. All three have strong ties to the neighborhoods. Two are openly gay, and one is a parent. All three have endorsements from strong progressive political leaders and groups. All three have significant political and policy experience and have proven themselves accessible and accountable.

And since it’s almost inconceivable that any of the three will collect more than half of the first-place votes, the second-place and third-place tallies will be critical.

Campos, a member of the Police Commission and former school district general counsel, arrived in the United States as an undocumented immigrant at 14. He made it to Stanford University and Harvard Law School and has worked as a deputy city attorney (who helped the city sue PG&E) and as a school district lawyer. He’s been a progressive on the Police Commission, pushing for better citizen oversight and professional police practices. To his credit, he’s stood up to (and often infuriated) the Police Officers’ Association, which is often a foe of reform.

Campos doesn’t have extensive background in land-use issues, but he has good instincts. He told us he’s convinced that developers can be forced to provide as much as 50 percent affordable housing, and he thinks the Eastern Neighborhoods Plan lacks adequate low-cost units. He supports the revenue measures on the ballot and wants to see big business paying a fair share of the tax burden. He argues persuasively that crime has to become a progressive issue, and focuses on root causes rather than punitive programs. Campos has shown political courage in key votes — he supported Theresa Sparks for Police Commission president, a move that caused Louise Renne, the other contender, to storm out of the room in a fit of cursing. He backed Aaron Peskin for Democratic Party chair despite immense pressure to go with his personal friend Scott Weiner. Ammiano argues that Campos has the right qualities to serve on the board — particularly the ability to get six votes for legislation — and we agree.

Eric Quezada has spent his entire adult life fighting gentrification and displacement in the Mission. He’s worked at nonprofit affordable-housing providers, currently runs a homeless program, and was a cofounder of the Mission Anti-Displacement Coalition. Although he’s never held public office, he has far more experience with the pivotal issues of housing and land use than the other two progressive candidates.

Quezada has the support of Sup. Chris Daly (although he doesn’t have Daly’s temper; he’s a soft-spoken person more prone to civil discussion than fiery rhetoric). If elected, he would carry on Daly’s tradition of using his office not just for legislation but also as an organizing center for progressive movements. He’s not as experienced in budget issues and was a little vague about how to solve the city’s structural deficit, but he would also make an excellent supervisor.

Mark Sanchez, the only Green Party member of the three, is a grade-school teacher who has done a tremendous job as president of the San Francisco school board. He’s helped turn that panel from a fractious and often paralyzed political mess into a strong, functioning operation that just hired a top-notch new superintendent. He vows to continue as an education advocate on the Board of Supervisors.

He told us he thinks he can be effective by building coalitions; he already has a good working relationship with Newsom. He’s managed a $500 million budget and has good ideas on both the revenue and the spending side — he thinks too much money goes to programs like golf courses, the symphony, and the opera, whose clients can afford to cover more of the cost themselves. He wants a downtown congestion fee and would turn Market Street into a pedestrian mall. Like Campos, he would need some education on land-use issues (and we’re distressed that he supports Newsom’s Community Justice Center), but he has all the right political instincts. He has the strong support of Sup. Ross Mirkarimi. We would be pleased to see him on the Board of Supervisors.

We’ve ranked our choices in the order we think best reflects the needs of the district and the city. But we also recognize that the progressive community is split here (SEIU Local 1021 endorsed all three, with no ranking), and we have nothing bad to say about any of these three contenders. The important thing is that one of them win; vote for Campos, Quezada, and Sanchez — in that order, or in whatever order makes sense for you. Just vote for all three.

District 11

3. JULIO RAMOS


This is one of those swing districts where either a progressive or a moderate could win. The incumbent, Gerardo Sandoval, who had good moments and not-so-good moments but was generally in the progressive camp, is termed out and running for judge.

The strongest and best candidate to succeed him is John Avalos. There are two other credible contenders, Randy Knox and Julio Ramos — and one serious disaster, Ahsha Safai.

Avalos has a long history of public-interest work. He’s worked for Coleman Advocates for Children and Youth, for the Justice for Janitors campaign, and as an aide to Sup. Chris Daly. Since Daly has served on the Budget Committee, and at one point chaired it, Avalos has far more familiarity with the city budget than any of the other candidates. He understands that the city needs major structural reforms in how revenue is collected, and he’s full of new revenue ideas. Among other things, he suggests that the city work with San Mateo County to create a regional park district that could get state funds (and could turn McLaren Park into a destination spot).

He has a good perspective on crime (he supports community policing along with more police accountability) and wants to put resources into outreach for kids who are at risk for gang activity. He was the staff person who wrote Daly’s 2006 violence prevention plan. He wants to see more affordable housing and fewer luxury condos in the eastern neighborhoods and supports a congestion fee for downtown. With his experience both at City Hall and in community-based organizations, Avalos is the clear choice for this seat.

Randy Knox, a criminal defense lawyer and former member of the Board of Appeals, describes himself as "the other progressive candidate." He supports Prop. H and the affordable-housing fund. He links the crime problem to the fact that the police don’t have strong ties to the community, and wants to look for financial incentives to encourage cops to live in the city. He wants to roll back parking meter rates and reduce the cost of parking tickets in the neighborhoods, which is a populist stand — but that money goes to Muni, and he’s not sure how to replace it. He does support a downtown congestion fee.

Knox wasn’t exactly an anti-developer stalwart on the Board of Appeals, but we’ll endorse him in the second slot.

Julio Ramos has been one of the better members of a terrible community college board. He’s occasionally spoken up against corruption and has been mostly allied with the board’s progressive minority. He wants to build teacher and student housing on the reservoir adjacent to City College. He suggests that the city create mortgage assistance programs and help people who are facing foreclosure. He suggests raising the hotel tax to bring in more money. He supports public power and worked at the California Public Utilities Commission’s Division of Ratepayer Advocates, where he tangled with PG&E.

We’re backing three candidates in this district in part because it’s critical that Safai, the candidate of Mayor Newsom, downtown, and the landlords, doesn’t get elected. Safai (who refused to meet with our editorial board) is cynically using JROTC as a wedge against the progressives, even though the Board of Supervisors does not have, and will never have, a role in deciding the future of that program. He needs to be defeated, and the best way to do that is to vote for Avalos, Knox, and Ramos.

Two of the stalwart progressive leaders on the San Francisco School Board — Mark Sanchez and Eric Mar — are stepping down to run for supervisor. That’s a huge loss, since Mar and Sanchez were instrumental in getting rid of the autocratic Arlene Ackerman, replacing her with a strong new leader and ending years of acrimony on the board. The schools are improving dramatically — this year, for the first time in ages, enrollment in kindergarten actually went up. It’s important that the progressive policies Mar and Sanchez promoted continue.

Sandra Fewer is almost everyone’s first choice for the board. A parent who sent three kids to the San Francisco public schools, she’s done an almost unbelievable amount of volunteer work, serving as a PTA president for 12 terms. She currently works as education policy director at Coleman Advocates for Children and Youth. She knows the district, she knows the community, she’s full of energy and ideas, and she has the support of seven members of the Board of Supervisors and five of the seven current school board members.

Fewer supports the new superintendent and agrees that the public schools are getting better, but she’s not afraid to point out the problems and failures: She notes that other districts with less money are doing better. She wants to make the enrollment process more accessible to working parents and told us that race ought to be used as a factor in enrollment if that will help desegregate the schools and address the achievement gap. She’s against JROTC in the schools.

We’re a little concerned that Fewer talks about using district real estate as a revenue source — selling public property is always a bad idea. But she’s a great candidate and we’re happy to endorse her.

Norman Yee, the only incumbent we’re endorsing, has been something of a mediator and a calming influence on an often-contentious board. He helped push for the 2006 facilities bond and the parcel tax to improve teacher pay. He’s helped raise $1 million from foundations for prekindergarten programs. He suggests that the district take the radical (and probably necessary) step of suing the state to demand adequate funding for education. Although he was under considerable pressure to support JROTC, he stood with the progressives to end the military program. He deserves another term.

Barbara "Bobbi" Lopez got into the race late and has been playing catch-up. She’s missed some key endorsements and has problems with accessibility. But she impressed us with her energy and her work with low-income parents. A former legal support worker at La Raza Centro Legal, she’s now an organizer at the Tenderloin Housing Clinic, working with immigrant parents. She’s fought to get subsidized Muni fares for SFUSD students. Her focus is on parent involvement — and while everyone talks about bringing parents, particularly low-income and immigrant parents, more directly into the education process, Lopez has direct experience in the area.

Kimberly Wicoff has a Stanford MBA, and you can tell — she talks in a sort of business-speak with lots of reference to "outcomes." She has no kids. But she’s currently working with a nonprofit that helps low-income families in Visitacion Valley and Hunters Point, and we liked her clearheaded approach to the achievement gap. Wicoff is a fan of what she calls community schools; she thinks a "great school in every neighborhood" can go a long way to solving the lingering issues around the enrollment process. That’s a bit of an ambitious goal, and we’re concerned about any move toward neighborhood schools that leads to resegregation. But Wicoff, who has the support of both Mark Sanchez and Mayor Newsom, brings a fresh problem-solving approach that we found appealing. And unlike Newsom, she’s against JROTC.

Jill Wynns, who has been on the board since 1992, has had a distinguished career, and we will never forget her leadership in the battle against privatizing public schools. But she was a supporter of former superintendent Ackerman even when Ackerman was trampling on open-government laws and intimidating students, parents, and staff critics, and she supports JROTC. It’s time for some new blood.

Rachel Norton, a parent and an advocate for special-education kids, has run an appealing campaign, but her support for the save-JROTC ballot measure disqualified her for our endorsement.

As a footnote: H. Brown, a blogger who can be a bit politically unhinged, has no business on the school board and we’re not really sure why he’s running. But he offered an interesting idea that has some merit: he suggests that the city offer free Muni passes and free parking to anyone who will volunteer to mentor an at-risk SFUSD student. Why not?

Community College Board

There are four seats up for the seven-member panel that oversees the San Francisco Community College District, and we could only find three who merit endorsement. That’s a sad statement: City College is a local treasure, and it’s been badly run for years. The last chancellor, Phil Day, left under a cloud of corruption; under his administration, money was diverted from public coffers into a political campaign. The current board took bond money that the voters had earmarked for a performing arts center and shifted it to a gym — then found out that there wasn’t enough money in the operating budget to maintain the lavish facility. It’s a mess out there, and it needs to be cleaned up.

Fortunately, there are three strong candidates, and if they all win, the reformers will have a majority on the board.

Milton Marks is the only incumbent we’re supporting. He’s been one of the few board members willing to criticize the administration. He supports a sunshine policy for the district and believes the board needs to hold the chancellor accountable (that ought to be a basic principle of district governance, but at City College, it isn’t). He wants to push closer relations with the school board. He actually pays attention to the college budget and tries to make sure the money is spent the right way. He is pushing to reform the budget process to allow more openness and accountability.

Chris Jackson, a policy analyst at the San Francisco Labor Council, is full of energy and ideas. He wants to create an outreach center for City College at the public high schools. He also understands that the college district has done a terrible job working with neighborhoods and is calling for a comprehensive planning process. He understands the problems with the gym and the way the board shuffles money around, and he is committed to a more transparent budget process.

Jackson is also pushing to better use City College for workforce development, particularly in the biotech field, where a lot of the city’s new jobs will be created.

Jackson was president of the Associated Students at San Francisco State University, has been a member of the Youth Commission, and worked with Young Workers United on the city’s minimum-wage law. His experience, energy, and ideas make him an ideal candidate.

Bruce Wolfe attended City College after a workplace injury and served on the Associate Students Council. He knows both the good (City College has one of the best disability service programs in the state) and the bad (the school keeps issuing bonds to build facilities but doesn’t have the staff to keep them running). As a former member of the San Francisco Sunshine Ordinance Task Force, Wolfe is a strong advocate for open government, something desperately needed at the college district. He told us he thinks the college should agree to abide by the San Francisco Planning Code and is calling for a permanent inspector general to monitor administration practices and spending. He wants City College to start building housing for students. He has direct experience with the district and great ideas for improving it, and we’re happy to endorse him.

Incumbents Rodel Rodis and Natalie Berg are running for reelection; both have been a key part of the problem at City College, and we can’t endorse either of them. Steve Ngo, a civil rights lawyer, has the support of the Democratic Party, but we weren’t impressed by his candidacy. And he told us he opposes the Clean Energy Act.

Vote for Marks, Jackson, and Wolfe.

BART Board of Directors

With rising gasoline prices, congested roadways, and global warming, it’s now more important than ever to have an engaged and knowledgeable BART board that is willing to reform a system that effectively has San Francisco users subsidizing everyone else. That means developing a fare structure in which short trips within San Francisco or the East Bay urban centers are cheaper and longer trips are a bit more expensive. BART should also do away with free parking, which favors suburban drivers (who tend to be wealthier) over urban cyclists and pedestrians. San Francisco’s aging stations should then get the accessibility and amenity improvements they need—and at some point the board can even fund the late-night service that is long overdue. There are two candidates most capable of meeting these challenges:

District 7

LYNETTE SWEET


This district straddles San Francisco and the East Bay, and it’s crucial that San Francisco—which controls just three of the nine seats—retain its representative here. We would like to see Lynette Sweet more forcefully represent the interests of riders from San Francisco and support needed reforms such as civilian oversight of BART police. But she has a strong history of public service in San Francisco (having served on San Francisco’s taxi and redevelopment commissions before joining the BART board in 2003), and we’ll endorse her.

TOM RADULOVICH


Tom Radulovich is someone we’d love to clone and have run for every seat on the BART board, and perhaps every other transportation agency in the Bay Area. He’s smart and progressive, and he works hard to understand the complex problems facing our regional transportation system and then to develop and advocate for creative solutions. As executive director of the nonprofit Livable City, Radulovich is a leader of San Francisco’s alternative transportation brain trust, widely respected for walking the walk (and biking the bike—he doesn’t own a car) and setting an example for how to live and grow in the sustainable way this city and country needs.

Songs in silver

Meara O’Reilly has brought a book to our meeting at a café near her Mission District apartment. The author is Mary Hallock-Greenewalt, a visionary musician-inventor who worked toward synthesizing light and sound in the 1920s. It’s a special kind of musician who feels compelled to devise her own instrument, and O’Reilly takes obvious pleasure in having discovered a predecessor.

Her own tonal invention, which provides the cornerstone for her music as Avocet, is an elegant metal hanger on which a half-dozen silver forks dangle in front of contact microphones, suspended by threads of horsehair. "Michael Hurley calls it the belladonna," she notes with a laugh. O’Reilly’s instrument still doesn’t have a fixed name, although there is something of an origin story: "I had these amazing pieces of silver my godmother had given me. I would drop them, and they would ring out for 10 seconds or so. It was so beautiful."

The Sebastopol native devised her resonating instrument while living on a dairy farm in Vermont. "I played a show with it when it was really in prototype form, and I was actually using my own hair," she recounts. "My hair wasn’t thick enough, so it kept breaking. It actually sounds really good, though, better than the horse hair." Avocet’s hear-a-pin-drop live sets make for a bracing contrast with O’Reilly’s previous gig with Feathers, a New England psych-folk collective that released a single album before parting company. The instrument-swapping group afforded her the social comfort of a band, but it was only one part of a private musical development encompassing everything from noise rock to gamelan.

O’Reilly periodically switches to guitar in her sets, though her unconventional fascination with sound still shines through on the more familiar instrument. She sings songs from Greece and Mongolia and professes a deep interest in the distinct tonal possibilities of different tongues. The drifting sustain of her performances is generally blue, with notes and melodies in free-flight, perilously close to oblivion. In spite of the obvious volume differential, Avocet might fairly be compared with any number of sculptural drone bands. She is, after all, a student of metal. "I’ve been trying to learn about different eras of silver because there are different putf8gs and compositions of the metal," O’Reilly says. "So other than just looking at the shape and figuring out the physics of what note [a fork] would be, there’s also the composition of it." Then she finishes the thought, "I’d like to know more." 2

REVIEW Romeo and Juliet — the ballet, not the play — is not exactly known for its wit. Prokofiev’s heavy-handed use of thematic material at times makes Wagner sound frivolous. But leave it to Mark Morris to turn ballet’s most beloved 20th-century tragedy into a fairy tale whose comedic overtones are difficult to miss. Does the piece — which was given its West Coast premiere by Cal Performances at Zellerbach Hall Sept. 25 — work? Up to a point it does, because Morris set clearly defined parameters and shaped his take accordingly. At the end, however, the choreographer falls flat on his face.

Morris’ Romeo and Juliet, on Motifs of Shakespeare is the result of musicologist Simon Morrison’s discovery of the composer’s original manuscript in Russia. It doesn’t include a balcony scene, nor do the lovers die. The most welcome revelation is that the music was not designed to hit you over the head. The orchestration is thinner, shading its colors instead of splashing them on.

When tackling the largely unchanged libretto, Morris decided to keep the story at arm’s length. His characters are not quite flesh-and-blood people. The dancers inhabit their roles against the backdrop of a story we already know well. And they do it superbly. In many ways, Morris is playing a game with us. It’s witty, fun, and distanced.

The minute the work opens and we see the good citizens with their wooden swords, you know that this is make-believe. There is no conflict between these families: everybody, including the parents, is immature. Hormones rage. Stuff happens. The whole society is kept together by Escalus (a fabulously effective Joe Bowie) who prowls the town like a playground supervisor.

Morris’ handling of the crowd scenes works. He treats them like accidental encounters, akin to neighborhood gossip that swells then recedes. It’s one way of dealing with Prokofiev’s propensity for repetition. The ballroom scene’s formality resembles early Martha Graham with Romeo posturing like a pouting teenager. In a nod to the famous pillow dance, Morris includes a parlor game involving a cushion.

He explores a similar thematic development in the market scenes. A hop and turn motive spools the citizens on stage as if they were coming off a conveyor belt. As for the love story, Morris makes it into a puppy love that unexpectedly grows into something the kids can no longer handle. Noah Vinson’s Romeo is splendid, tender and ready to jump out of his skin from sheer happiness. Maile Okamura’s Juliet evolves nicely into take-charge maturity.

In the end, Morris’ Romeo falls apart. The divertissements in the bedroom look like caricatures, as do Romeo’s and the Friar’s ex machina appearances. Morris’ imagination fails him badly as he transports the lovers into a literally star-crossed universe. The choreographer prides himself on using every note of a composer’s music, but perhaps that’s not always such a hot idea.

Back to Oakland?

Big money is flowing into an Oakland City Council campaign, fueling rumors that state Senate President Don Perata might be preparing for a Willie Brown–style move from Sacramento kingpin to Bay Area mayor.

Perata’s former chief of staff Kerry Hamill is vying for the city’s at-large council seat, running against AC Transit board member Rebecca Kaplan. Two independent expenditure committees with possible links to Perata are laying out tens of thousands of dollars on Hamill’s behalf. Sources say Perata has been fundraising for his ex-staffer, as has Oakland City Council President Ignacio De La Fuente, a longtime Perata loyalist. And it appears one of De La Fuente’s efforts to raise cash may have skirted the boundaries of state law.

The stakes for De La Fuente are definitely high. Hamill’s election would help him retain his role as president of the closely divided council. But the scuttlebutt around Oakland is that a successful Hamill candidacy could have bigger implications. It might just pave the way for something many local observers see as inevitable: a Perata run for mayor.

Current Mayor Ron Dellums is reeling from a spike in violent crime, huge budget deficits, and a detached leadership style, all of which is fueling a nascent recall movement. Perata will be termed out of state office this year and has made no secret of his interest in Oakland’s top job, despite allegedly being the target of an ongoing political corruption investigation by the FBI. Having a powerful colleague like Hamill on the council, while keeping De La Fuente in control of the body, could make a run for mayor attractive to Perata (who didn’t return our calls for comment).

"He’s going to run. Everybody knows he’s going to run," Oakland City Attorney John Russo told the Guardian, adding that the flurry of campaigning for Hamill is "absolutely a signal" of Perata’s mayoral ambitions. "That group of people [Perata and his allies] clearly see their interests lying with Kerry."

Reached for comment, Hamill said, "Don’s supporting me because I’m the best candidate…. Whether it is for selfish reasons like making sure the right people for him are on the council or not, I believe he is supporting me because he likes my work."

OUTSIDE INFLUENCE


If you live in Oakland or have spent any time there recently, chances are you’ve seen the pro-Hamill campaign signs promising "Safe Neighborhoods Now" affixed to fences and lampposts all over town. Oakland mailboxes have been stuffed with flyers backing Hamill’s candidacy. The signs and some of the other materials position Hamill in opposition to Dellums more than Kaplan, with one mail piece hammering the current mayor for his handling of the city’s recent crime wave.

Hamill’s campaign did not produce the signs or much of the literature championing her. Instead, two newly formed independent expenditure committees doled out more than $87,000 on her behalf in the first half of this year alone. The groups are not required to disclose their recent spending until Oct. 6, but given the volume of material being generated, there is little doubt their combined outlays will top $100,000 for the year. Hamill told us that outside groups are also aiding her opponent Kaplan, though she did not name them. Our examination of campaign records found that the California Nurses Association paid $24,535 for a pro-Kaplan mailer in May.

"That’s definitely a lot of money," Alameda County supervisor Keith Carson told us, referring to the spending in support of Hamill. "It certainly raises your antenna. In any campaign when you have two separate entrants putting resources in, you pause and ask, ‘What’s behind it?’<0x2009>"

On the surface the two groups backing Hamill appear unconnected. But recent media reports and a Guardian examination of campaign finance records reveal several ties between both organizations and Hamill’s old boss, Perata.

The first group, which calls itself Californians for Good Jobs, Clean Streets, and Outstanding Schools, displays clear Perata associations. The group’s treasurer is Mark Capitolo, who used to be Perata’s director of communications. Many of its donors consistently give to Perata’s numerous political action committees. And its campaign documents list a Sacramento phone number that, as the East Bay Express reported in May, belongs to Perata’s chief political strategist, Sandra Polka.

Polka and employees of her consulting business appear to be deeply involved in the senator’s affairs. When we called Perata’s Sacramento office seeking comment for this story, we were told to contact Paul Hefner, who works for Polka’s firm. Polka, Hefner, De La Fuente, Capitolo, and Californians for Good Jobs president, Hilda Martinez, did not return our calls for comment.

Perata’s links to the second group, known as Oakland Jobs PAC, are not as immediately apparent, and one person involved with the group denied that the legislator is aiding their cause. But an inspection of disclosure forms did yield evidence of the legislator’s potential influence. In mid-May, Oakland Jobs received its first $10,000 from another political action committee known as Vote Matters. As the Contra Costa Times reported, Vote Matters spent more than $175,000 earlier this year trying to pass Proposition 93, which would have allowed Perata and other termed-out state politicians to remain in office. Perata strongly supported the measure, which did not pass.

Robert Apodaca, who called himself a "personal friend" of Perata’s, informed the Guardian that he recommended that Vote Matters provide the money to Oakland Jobs. Apodaca is director of marketing for the architecture and planning firm MVE and Associates, which designed the huge Oak to Ninth Project along the Oakland waterfront. Perata passed key legislation that allowed the project to move forward, though it has yet to be built. Oakland Jobs donor Signature Properties is one of the project’s lead developers and, according to the East Bay Express, Oakland Jobs’ treasurer Sean Welch has worked for Signature Properties in the past. Signature Properties has also been a donor to Perata’s political committees, as have several other Oakland Jobs contributors.

In addition to his work for MVE and what he deemed his "unpaid advisor" relationship with Vote Matters, Apodaca is listed as a paid campaign consultant for a now-defunct committee called the "California Latino Leadership Fund" (CLLF). CLLF employed Polka as well as Apodaca in 2006 and 2007. Polka is now working on behalf of the other committee backing Hamill this year, Californians for Good Jobs, Safe Streets, and Outstanding Jobs.

DEVELOPERS’ DEEP POCKETS


Apodaca told us he could not remember why he pushed for Vote Matters, which normally supports state candidates and initiatives, to give money to a local committee like Oakland Jobs. But he was certain that Perata played no part in it. "He’s not involved in [the committee’s decisions]. He’s not even in the room."

But a well-placed East Bay source told us Perata was in the room with Oakland Jobs–affiliated figures while money was being sought to support Hamill. The source, who asked not to be identified, said Perata was part of a breakfast meeting several months ago at the downtown offices of the Oakland law firm of Wendel, Rosen, Black and Dean, at which De La Fuente asked a group of prominent developers to give large sums of money to an independent expenditure committee that would back Hamill.

The source could not recall if the committee was named by De La Fuente or anyone else at the meeting. But according to the source, pro-development activist Greg McConnell was there. McConnell told us he is involved in running Oakland Jobs. His business, the McConnell Group, has received funding from the group. The source also said representatives from Signature Properties and developer Forest Hill, another Oakland Jobs donor, were in attendance and that De La Fuente expressed an interest in raising "over a hundred grand" for the race.

A second source confirmed that Perata was at the meeting in question but did not recall De La Fuente asking for the funds, though the second source did say De La Fuente has subsequently called seeking money for Hamill’s campaign.

Reached for comment, McConnell asserted that Perata is not involved with Oakland Jobs. He said a morning meeting did take place at the Wendel, Rosen firm "a couple of weeks ago," during which Perata asked the developers in attendance to contribute directly to Hamill’s campaign. But according to McConnell, Perata left the room before De La Fuente made a pitch to fund independent expenditures. Direct contributions to candidates are limited to $600 per donor in Oakland. Independent groups like Oakland Jobs are not subject to those restrictions.

‘NOT KOSHER’


In addition to learning of De La Fuente’s alleged fundraising pitch at a recent developers’ meeting, the Guardian has obtained a letter from De La Fuente to potential Hamill donors asking them to attend a $600-a-head event Oct. 2. Nothing in the letter itself, dated Sept. 16, appears to violate any campaign finance rules. But it is printed on what appears to be official City of Oakland letterhead, complete with the official seal. That could mean trouble for De La Fuente.

"That’s not kosher," Mark Morodomi, the supervising deputy in the Oakland city attorney’s office, told us. State law prohibits the use of government resources for political campaigning. Before coming to Oakland, Morodomi spent 10 years at the California Fair Political Practices Commission, the state’s campaign-finance watchdog.

A line in small type on the bottom of the letter reads, "Not printed or mailed at public expense." Morodomi said the phrase "comes close" to making the use of city letterhead permissible, but he added, "It doesn’t inoculate him. Magic language doesn’t automatically make it okay … those words have to be true."

According to Morodomi, if any part of generating and disseminating the missive involved taxpayer-funded resources — from printing costs to paper, envelopes, or stamps — De La Fuente would be in violation of the law. Using Oakland’s official seal could also be problematic.

Hamill dismissed concerns that the invitation tested the limits of the law: "I’ve been around for 20 years, and I’ve seen council members use that kind of stationary for fundraisers all the time."

But City Attorney Russo, Morodomi’s boss, that even if the letter turns out to be technically legal because no public resources were used, he is uncomfortable with De La Fuente’s decision to mix fundraising with official city documentation: "It’s not great form. You have to be really mindful as to how it would appear."

Newsom’s problem with affordable housing

OPINION No mayor in modern San Francisco history has opposed more affordable-housing initiatives than Gavin Newsom. It’s time to make him pay the political price.

Newsom is the primary foe of Proposition B, which would create an affordable-housing fund in the city’s budget. At a time when fewer than 1 in 10 San Franciscans can afford the cost of a median-priced home and some 40 percent of all tenants spend 50 percent or more of their income on rent, the mayor’s position is a civic tragedy.

There’s currently only about $3 million permanently budgeted to affordable housing in the city’s $6 billion budget. Proposition B would increase that to about $30 million. Half of the funds would go to the construction of homes of two bedrooms or more for families with dependents, and 40 percent would be earmarked for homes affordable to people earning $18,000 a year or less (including seniors, people with AIDS, people at risk of homelessness, and our neighbors with other special needs).

The measure is supported by the Democratic Party, the Labor Council, the Sierra Club, and more than 50 other neighborhood, community, and environmental organizations.

Newsom’s opposition to Prop. B has to be placed in the context of his opposition to every major affordable-housing initiative proposed by either the Board of Supervisors or neighborhood residents over the past five years. Newsom and his administration opposed affordable-housing mandates for the Hunters Point Shipyard, proposals to increase affordable-housing fees for market-rate developers in the Market/Octavia Plan area, and increased affordable-housing fees for developers of the high-rise luxury condos at Rincon Hill. And, in a stunning display of arrogance and indifference, he refused to allocate some $30 million appropriated for affordable housing by the Board of Supervisors last year — and then held a campaign-style rally in support of that refusal, arguing that the city already spent enough on affordable housing!

Last month, Newsom’s Planning Commission passed on to the Board of Supervisors an Eastern Neighborhood Plan under which less than a quarter of the new units would be affordable to anyone earning less than $120,000. The city’s own General Plan says San Francisco needs nearly two-thirds of all new units to be affordable if the city is to house its own workforce — a key requirement in any green, "smart growth" development policy of the type the mayor says he favors.

Newsom claims his opposition to Prop. B stems from his concern about set-asides in the budget. Yet Newsom, as mayor and supervisor, has supported every other set-aside placed on the ballot. It’s just affordable housing that he opposes — even though Prop. B, which sunsets after 15 years, would account for less than 2 percent of the budget over that period and would leave some $47 billion in discretionary funds on the table.

The fact that Newsom has paid no political price for his continuous opposition to affordable housing is stunning. It’s time to change that — pass Proposition B with a resounding yes vote this November.

Kink dreams

When it comes to BDSM porn peddlers Kink.com, apparently size does matter. At least, that’s how it seems now that the steamy studio has purchased the 200,000-square-foot San Francisco Armory. Suddenly, everyone wants to know: What’s the carnal concern going to do with all that space?

The answers are more diverse and ambitious than one might expect — ranging from creating a racy reality show to starting a perfectly PG-13 public community center. And thanks to the lascivious and lucrative imagination of Kink.com founder Peter Acworth, it might all be possible.

CONCEPTION AND CONTROVERSY


Though Kink.com has been producing independent niche fetish sites like Hogtied.com, WiredPussy.com, and FuckingMachines.com for the Folsom Street Fair crowd for more than 10 years — first from Acworth’s rented Marina District apartment and then from the Porn Palace on Fifth and Mission streets — it wasn’t until Acworth purchased the historical landmark in the Mission District, and was met with opposition, that the provocative porn empire really made it onto the public’s radar screen.

The armory, which was a training ground for the National Guard prior to its decommissioning 30 years ago, has been the center of controversy before. But that was mostly in-fighting between potential developers. Stringent zoning requirements and necessary but cost-prohibitive renovations discouraged buyers, leaving the Moorish behemoth on 14th and Mission streets vacant and outside public scrutiny.

But everything changed when Acworth got involved. His intended commercial use, for shooting scenes for all of Kink’s Web sites, complied with planning codes. And he didn’t need to do expensive renovations before he could start using, and profiting from, the building: what could be more perfect for bondage shoots or movies about women fucking machines than dungeons in disrepair? The only thing more ideal than the structure itself, according to Acworth, was its location in the heart of America’s most fetish-friendly city. "You couldn’t have dreamt up a more perfect place than a castle in the middle of San Francisco," says Acworth, who purchased the armory for $14.5 million in 2007 and started operations in January of this year. "It’s like divine intervention."

Acworth had to contend with a different kind of intervention — from a neighborhood group called the Mission Armory Community Collective, which opposed Kink.com as a potential neighbor. Though careful not to condemn porn per se, the group said it feared that the company’s presence in an already troubled neighborhood would introduce more problems. Even the Mayor’s Office, potentially bending to pressure, issued the following statement: "While not wanting to be prudish, the fact that kink.com will be located in the proximity to a number of schools give [sic] us pause."

But the sale quietly went through, and even as protesters stood outside, Kink was already filming new scenes for its subscription sites. Since then, the protests have largely died down. As the company removed graffiti from the brick facade of the armory, fixed windows, and generally improved the appearance of its stretch of Mission Street, neighbors began stopping by to congratulate Acworth — or to ask for a tour. On a September afternoon, the building — mostly nondescript from the sidewalk except for the castlelike rooftop — seems quiet and innocuous. Three boys skateboard on the steps outside, stopping to talk to a woman walking her dog. The only people entering the doors, which are always locked and manned by a security guard, look as though they could’ve been going to the grocery store or the gym, wearing shorts, T-shirts, and sandals. In fact, on first glance inside, the place is almost disappointingly tame.

Acworth himself hardly looks like a porn kingpin. He’s sweetly attractive in an unmenacing, mainstream way, with an easy smile and casual style. His office, a room near the entrance to the armory, is large and comfortable, but bears no hint of his livelihood save for one tasteful bondage statue. Next to his desk are water and food bowls for the armory’s two live-in cats: Rudy and Lala. His assistant, a young girl in a minidress, leggings, and hoop earrings, looks like she could be working at American Apparel. Even the desktop pattern on Acworth’s Dell computer screen is vanilla: rolling green hills beneath a blue, blue sky. This sense of normalcy seems to be Kink’s main point.

Acworth remembers getting turned on as a child in England by scenes in movies where women were tied up — and wondering if this signaled violent tendencies within himself. It wasn’t until adolescence that he discovered the relief (and release) of bondage porn. At the same time, he was already a burgeoning entrepreneur, a child who grew vegetables behind his house and tried to sell them to his parents. By the time he read a magazine article about a man making millions from Internet porn, as a Wall Street–bound doctoral student in a Columbia University finance program, it seemed almost inevitable that Acworth would find a way to marry his two lifelong interests: bondage and business. When he founded Kink.com in 1997, the idea was not only to jump on the dot-com money train, but also to demystify and promote fetish porn as an acceptable form of sexual stimulation.

Now, each of Kink.com’s Web sites is geared toward a particular fetish, run by a Webmaster who’s not only an expert on that particular kink but also has an interest in it, just as Acworth started Hogtied.com, which features women tied up, and Fuckingmachines.com, which showcases women having sex with machinery, because that’s what turned him on. These Webmasters act as director, producer, human resources manager, and often participant as well as Web developer.

"It’s hard to guess what people want," he explains, pointing out that it’s easier to make what you know.

Which means models aren’t actors. Just as directors are expected to be interested in the fetish they’re promoting, so are participants expected to enjoy the scenes they’re in. This isn’t about fake-breasted women pretending to like a face full of come. In fact, Acworth has had trouble in the past working with models from Los Angeles, trying to get them not to act. Kink’s sites feature actual people enjoying a private play party that just happens to be taped. Videos are intimate, personal, and disarmingly real — models talk to each other before, during, and after their sessions, just the way they would in their own bedrooms. They’re encouraged to smile on camera. Whether it’s shocking a woman with electric instruments or forcing a man to eat from a dog bowl, you get the sense that these people would be playing out these scenarios anyway — Kink just provides a salary, benefits, and a really nice location.

THE KINK CASTLE


As for the building itself, Kink has just begun to scratch the surface of its possibilities. The first floor, perhaps the most institutional-looking of the four, houses offices for Acworth, the marketing team, the production team, and the break room, which features a pool table, a disco ball, an espresso machine, a drum set, and a DJ booth (all for parties as well as employee use). Directly opposite the front doors is the Drill Court, a monstrous space that looks something like an airplane hangar crossed with a European train station. This is the space Acworth hopes will become the Mission Armory Community Center (which would unintentionally bear the same acronym as one of the groups that protested Kink.com’s purchase of the armory), a public venue available for sporting events, educational seminars, film festivals, and someday maybe a Folsom Street Fair party. According to MACC coordinator David Klein, a developer who has no affiliation with Kink.com, that dream is a long way off — with plenty of renovations, public meetings, and applications standing between here and there. In the meantime, the Drill Court serves as an occasional event site (such as for the Mission Bazaar craft fair earlier this year) and an employee parking lot. Currently, the most public location is the Ultimate Surrender room, where small numbers of members are invited to sit in bleachers and watch women wrestle each other to the ground on large mats — the winner, of course, gets to fuck the loser.

The armory’s basement is by far the most interesting area. "It’s a wonderland of sets," says Acworth, and it’s hard to argue with him. Some rooms seem perfect as is, such as a former gymnasium whose floor has long since been removed to reveal gothic-looking structural planks punctuated by intimidating bolts. All it took was adding a platform in the center of the expansive room and a pulley above it to make it a perfect bondage set. Next door is an army-style communal bathroom, another favorite as-is set. Other rooms on this floor are a completely furnished 1970s New York loft; a padded cell with an observation room connected by a one-way mirror; a former hermetically sealed gunpowder room that’s been outfitted with all sorts of rings, hooks, and rope pulleys; an office connected by a cage to the "Gimp Room," where ceiling chains hang like some kind of Donkey Kong homage; a hallway storage room chock-full of expected (whips, chains, clamps) and unexpected (mops, long-handled brushes with hard bristles, small boxes with smaller holes in them) toys; the large prop room, where human-shaped cages, monstrous doghouses, and machines like the back breaker and water-torture wheel are kept; the laundry room, where shelves are lined with douches, enemas, latex gloves, and sanitized sex toys; and the former shooting range, which has a Pirates of the Caribbean feel, complete with a river running through it.

And that’s just the start of it. Just when you think every nook and cranny has been used — including an oddly shaped corner off the production gallery that looks like a 19th-century psychiatric ward — you’ll discover a hallway that’s virtually untouched. Hardly any construction has been done on the third or fourth floors, including the officers’ quarters, which occupy one turret. Even the roof, with its castle-y details and flags, seems like a perfect potential shooting location.

Kink already has plans for several new sets: the military clean room, a stark ’50s-era space, slated for FuckingMachines; an abandoned electrical equipment room for WiredPussy, where dead vintage electrical equipment will line the walls; an Alcatraz-esque prison gallery for BoundGods.com; and an expanded DeviceBondage.com room, which will be clad with cultured stone to look like the basement of an old castle.

Reps won’t say just how much it costs to maintain the armory or to shoot a scene, but Acworth told 7×7 magazine last year that profits were upward of $16 million. And spokesperson Thomas Roche says that the cost of a shoot, including sets, makeup, wardrobe, video and still photo staff, and editing, would be prohibitive if Kink weren’t doing lots of them. Luckily, the armory allows for a volume of shoots that makes it feasible — sometimes four or five in a single day. And it’s good variety for viewers too, who get used to seeing the same sets over and over in various porn films — even ones by different companies.

FLIRTING WITH THE FUTURE


Perhaps the most advantageous thing about moving into the armory, though, has been the increased possibilities for Kink’s growth. With so much space, an almost infinite number of sets can be created without tearing any old ones down. Since multiple shoots can go on at once, multiple sites can be developed and maintained. And buying the building has started attracting directors, models, and Web developers on a scale Acworth hasn’t seen before.

"It was initially difficult to find people," says Acworth, who conjectures that it’s not just the publicity from the building but also the exciting prospect of working there that’s turned the tide. "Now they’ve started to approach us."

One of those who approached Acworth was Van Darkholme, a Shibari rope bondage expert, a porn performer, and the proprietor of fetish film studio Muscle Bound Productions, who was living in LA. Darkholme saw an article about Acworth and the armory in a magazine and contacted him immediately, hoping to get involved. The Vietnam-born Darkholme, who seems almost starstruck by Acworth’s genius, was shocked not only to hear back from Acworth himself, but to be offered a job at the helm of Kink’s new gay bondage site: BoundGods.com.

"What Peter does is so avant-garde and so fresh, I just wanted to come in and mop the floor," says Darkholme, who moved to San Francisco in April and launched his new site Aug. 1.

Darkholme’s BoundGods takes Kink’s principles of intimate, conversational, playful, and mutually enjoyable interactions and applies them to his particular brand of gay sexuality: lean, muscled studs. In one video, a man is tied up in the army-style bathroom at the armory while another fucks him with a large black dildo. In a similar scene, anal beads are gradually pulled from the bound, naked man — much to both participants’ obvious pleasure (though interestingly, neither are hard). Darkholme makes appearances in many of the videos, often as the dominant character — a striking contrast to the camo-shorts-and-T-shirt-wearing, somewhat shy individual I interview at the armory.

He’s clearly proud of the product, not only because it’s well produced but also because there’s almost no competition in the gay market.

"I hate to generalize, but most of what I see out there falls into this trap of gay men putting on leather and grunting and groaning," says Darkholme. "It’s visual, but doesn’t have as much dialogue. What we do is very real and very intimate, with a realness in what they’re saying."

The site marks Kink’s first serious foray into the gay market — a step the company couldn’t quite take while limited by space and resources at the Porn Palace. But set builders are already hard at work constructing an Alcatraz-esque prison gallery for new Boundgods shoots. And the creation of a sub-brand, KinkMen.com, promises more gay-focused fetish sites to come. (Incidentally, Kink tried a gay site several years ago with Butt Machine Boys, which is still online at www.buttmachineboys.com but not listed on the main Web site. Acworth said the site never took off, partly because of lack of budget and partly because, unlike Darkholme, the director wasn’t speaking to his personal interests.)

For now, though, Darkholme has his hands full with BoundGods. His immediate goal is to find and train 12 new dommes for the Web site — a tougher feat than might be expected. "Femme dommes can dish it out and can really take it," he says. "There’s a small percentage of men that can do that." In fact, during some of his first shoots, filmed in Budapest, his bevy of gay models and porn stars were shocked when Darkholme finally opened up his bag of toys.

"They looked at me like the circus had come to town, or like I was going to make one of the Saw movies. Their hands were shaking," he says.

So when Kink sets up its demonstration booth at Folsom Street Fair (Sept. 28, www.folsomstreetfair.com), Darkholme will have two purposes: recruiting talent (both people he can train and experts who have something to teach him) and publicizing his new brand.

"I want to say, ‘We’re here, we’re queer, we want to be part of your community!’" he laughs.

But Darkholme won’t be alone at his booth. Among other popular Kink stars like Isis Love, new director Lochai, expert rigger Lew Rubens, and porn stars LaCherry Spice and Natassia Dream will be WiredPussy.com creator Princess Donna, who’s launching her new pet product, PublicDisgrace.com, next month. The site will feature blatant public bondage, punishment, erotic humiliation, and explicit sex between models and, potentially, passersby.

The veteran domme is filming most scenes in Europe, where attitudes (and therefore laws) about sex are more lax. In fact, while shooting a scene on a public street in Berlin, the crew was stopped by a couple of motorcycle cops who said only, "If you cause an accident, you’ll be liable," before going on their way. In the shoot, a half-naked girl is tied to a park bench, made to carry a dog bowl while on a leash, fondled by her female master, and fucked by a man.

"It’s the adrenaline rush of potentially getting caught," says Acworth, explaining the site’s appeal and recipe for success. The site will also feature a slew of new faces. Plus, it’s the perfect time of year to launch a new fetish site. "Sales pick up when the kids go back to school," Acworth says.

There also plenty of developments in the works that don’t follow the start-a-new-fetish-site model. For starters, Kink is moving to a Flash format, where the delay is only 2 seconds instead of 20. The new technology means that users can actively participate in scenes via chat rooms, where they can give instructions to dommes and watch their demands be carried out. Members of Kink.com can already do this on DeviceBondage.com, but Acworth hopes to switch to a per-minute billing system so even more viewers can participate. At the moment, the site is structured so you must be a member of a particular site in order to watch videos; Acworth would like to move to a single-sign-on system where you can join Kink.com and have access to any of its member sites.

Perhaps the most ambitious technological plan for Kink’s future, though, is the development of an online Web community that will be called Kinky.com. Following the Web 2.0 trend of user-based content, Kinky.com will allow members and models to maintain user profiles, interact with one another on message boards, blog, and even date. Yes, it’s a way to stay up-to-date with Internet trends and to provide an experience that pirated video sites can’t, but Acworth says it’s also a natural outgrowth of the kind of porn he creates.

"In contrast with straight porn, which people want to consume in private, this is a community people want to be a part of," he says.

Which leads us to the project closest to Acworth’s heart: the reality show.

THE REAL WORLD: KINK.COM


In the spirit of community and BDSM as a lifestyle, Acworth wants to transform the armory’s top floor into a series of Victorian/Georgian-inspired rooms where couples will live and fuck on camera 24-7. Participants will be given hierarchical positions — from maid to master of the house — and live according to the rules of domination and submission. Acworth’s already started designing the grand dining room, inspired by the sets in Remains of the Day, including candelabras, elaborate draperies, and, of course, a long, long table. "I consider it the pinnacle of where everything comes together," he says.

The dream is still at least a year off: he’ll have to figure out payment and subscription details, renovate the nearly untouched top floor, and recruit couples who want to live their kinks on camera. But he’s hoping he’ll soon have more time to devote to the project. With more than 100 employees and a huge building to maintain, Acworth’s role has shifted from almost entirely creative to almost entirely administrative. He misses the early days, when he found models on Craigslist, tied them up in his rented Marina apartment, interacted with them himself, and then posted the shoots. (You can still see these early shoots online.) Soon he’ll promote an employee to chief operating officer, which will allow him to back off the business side and devote himself to the reality show.

So did he ever imagine his little project would get so big? Absolutely not, Acworth says. If he’d had any inkling, he adds, "I would’ve been terrified." But it only seems natural that the little English boy who used to try to sell his parents’ own vegetables back to them would eventually have an eye for business — and that his interest in fetish porn would lead his business instincts here.

As for how his parents feel about his chosen profession, Acworth says they’re not exactly vocally supportive, but they don’t condemn him either. His mom, a sculptor, has started creating pieces that feature couples in coital or bondage positions, and may start to sell them on the site. His dad, a former Jesuit preacher, says only, "As long as no one’s getting hurt and there are no animals, I guess it’s all right."

A planning primer for the supes

EDITORIAL The Eastern Neighborhoods Plan, which comes before the Board of Supervisors this month, is more than a set of rezoning and fee proposals. It’s a blueprint for how San Francisco sees its future as a city. When the supervisors are done with it, the plan will either preserve and expand the city’s affordable housing stock and protect blue-collar jobs, or it will usher in a vastly expanded land rush for developers who will wipe out small businesses that employ local residents and build tens of thousands of high-end condos for rich single people who work in Silicon Valley.

The stakes couldn’t be higher — and not just for the Mission, Potrero Hill, South of Market, and Dogpatch districts, but for the entire city. Because if the supervisors can’t get this right, the pattern will be set for development that will profoundly change the demographics (and politics) of this city.

The language the board will wrestle with is complicated, but the fundamental concepts are simple. And that’s where the discussion needs to start. For example:

Affordable housing can’t be a token concession; it has to be the heart of the plan. The city’s own general plan states that 64 percent of all new housing built in San Francisco should be made available at below market rates. That’s because the vast majority of the people who need housing in this city earn far less money that it takes to buy a market-rate unit. Even with the nationwide housing slump, new condos in the city start at $500,000 for a tiny studio or one-bedroom unit; places big enough for families cost a lot more. Even families with two wage earners who have decent, unionized jobs (like teachers, firefighters, and bus drivers) can’t afford the lowest-end market-rate homes.

Most discussions of affordable housing seem to start with the premise that forcing developers to set aside maybe 25 percent of their units for below-market sale is some sort of a victory. That’s nonsense. If 25 percent of the units in the Eastern Neighborhoods Plan are affordable, that means 75 percent will go to very rich people — and a city in which 75 percent of the population is rich while most of the people who work in the city’s major industries can’t afford to live in town is not a sustainable city.

The supervisors should set affordable housing at 64 percent — that is, compliance with the general plan as a bottom-line goal. Any aspect of the plan that doesn’t advance that goal needs to be examined and changed. If the evidence shows that to be an impossible standard, let’s negotiate down from there instead of taking the city’s anemic affordability levels and trying to bump them a few points up.

For example, the Mission Anti-Displacement Coalition has suggested that any height or density bonuses should be used for 100 percent affordable housing. Sup. Tom Ammiano is carrying that amendment to the plan, and it needs to be approved.

Developers have to pay to build new neighborhoods. You can’t just toss 40,000 new housing units into the eastern neighborhoods and expect to have a decent community. Neighborhoods needs parks and schools and bus lines — and the area targeted for this level of development has nowhere near the level of infrastructure it needs to handle the proposed housing influx.

So the developers who want to make money building housing also have to pony up for the public works and amenities that will make the plan viable. City officials estimate that the area needs $400 million worth of new infrastructure. The development fees currently proposed would cover less than half that. The ratio just doesn’t work: either the money is set aside — up front — to pay for neighborhood services and improvements, or the supervisors should reject the entire plan.

Blue-collar jobs can’t be sacrificed for more millionaires. The Planning Department admits that the current proposal will destroy hundreds of jobs in what’s known as production, distribution, and repair — jobs that offer decent wages for people who don’t have an advanced education. The city desperately needs those jobs. If the plan envisions new industries to replace the PDR facilities, those industries have to offer similar employment opportunities.

Residents of the eastern neighborhoods aren’t opposed to new development. But everyone in town ought to be fighting a developer giveaway that brings the city nothing.

A Prop. M for housing

San Francisco’s future as a creative and diverse progressive beacon is at risk due to the Planning Department’s Eastern Neighborhoods plan. The planning staff has decided the city’s need for luxury housing is so significant that it has set the development bar too low, allowing big builders to cash in on market rate housing.

Planning staff has labored to produce an inelegant community benefits and affordability model that has so many unproven moving parts it might barely work for current conditions but cannot be counted upon to provide for changing circumstances in the future.

But there is an existing successful city policy, passed by the voters in 1986 to control office sprawl, that can serve as a model for harnessing the insatiable demand to build profitable luxury housing, both for the benefit of existing San Franciscans as well as those of the non-rich who would seek refuge here in the future as so many of us did in the past.

Proposition M imposed a 950,000 square foot annual limit on office space. When applications to build exceed that cap, developers may offer up additional sweeteners to increase the chances of their projects being permitted.

The Western SoMa Citizens Planning Task force broke off from Eastern Neighborhoods planning process in 2004, and is nearing completion on its democratic, participatory, community-based plan. One policy that has caused consternation among the development types, who expect to run planning processes unhindered, has been a proposal to replicate Prop M, but this time, applied to housing.
