The Blue Angels buzzed the Castro Street Fair on Oct. 7, one of the planes missing the top of Twin Peaks by what looked like a few feet. And almost nobody seemed to notice.

The roar of the jets couldn’t possibly compete with the energy onstage, where Cookie Dough and the Monster Show were acting out a Wizard of Oz sketch to the sounds of "Boogie Oogie Oogie." I only saw one guy in the crowd even looking up, and he was just kind of shaking his head. Sailors are, of course, always popular in the Castro, but the United States Navy really isn’t.

A former Naval officer I know understands exactly why. She was drummed out years ago; the Naval Investigative Service followed her to a lesbian bar in New Orleans, and suddenly a talented and successful ensign who had just been promoted to lieutenant (junior grade) was tossed ashore, all benefits lost. She can joke about it now, but she’s still pissed.

The crazy thing of it all, she tells me, is that the Navy is "by far the gayest of all the services, and everyone knows it." If even this one branch just gave up the pretense and allowed queers to serve openly, she says, Fleet Week would take on a whole new meaning in San Francisco. But that’s not the only issue with Fleet Week, obviously. Like a lot of people in this town (and much of the queer community), I’m not terribly into the military, and I don’t like turning San Francisco into a giant, expensive recruitment ad. Besides, as we used to say about nuclear weapons, one Blue Angel can ruin your whole day: a few feet lower, a tiny mistake, and that F-A/18 flying toward Twin Peaks loaded with explosive jet fuel could have taken out hundreds of homes, killed thousands of people. It’s not as if it doesn’t happen; twice in the past year members of the Navy’s expert precision flying team have crashed.

There’s also the fact that this is a city overwhelmingly opposed to the war and to military adventurism in general. San Francisco’s idea of supporting the troops is bringing them home and giving them honorable discharges, medical care, and education benefits.

I’m always astonished that more local political leaders don’t just come out and say that. In fact, I’m astonished (although I probably shouldn’t be) that Mayor Gavin Newsom and Rep. Nancy Pelosi act as if Fleet Week is a wonderful San Francisco event, with no mention of the issues involved.

In fact, on June 11, after Sup. Chris Daly tried to ground the Blue Angels, Newsom wrote directly to David Winter, the secretary of the Navy, rolling out the red carpet. "My office and the community could not be more supportive of the Navy and their representatives, the Blue Angels," he wrote.

Nothing from Mr. Same-Sex Marriage about don’t ask, don’t tell. Nothing about the war. Nothing about San Francisco’s long and noble history as a center of the peace movement. Just praise for military might. He’s sounding a lot like Sen. Dianne Feinstein.

And by the way, on the contradictions beat: San Francisco is poised to give a huge, lucrative contract to Clear Channel Communications, one of the worst corporations in the country. Labor leaders are pissed, and they should be. I wonder: If there’s a lot of money to be made selling ads on bus shelters, why doesn’t the city just run the program itself? Why share the profits with the likes of Clear Channel?

Endorsements: Local ballot measures

Proposition A (transit reform)

YES


This omnibus measure would finally put San Francisco in a position to create the world-class transportation system that the city needs to handle a growing population and to address environmental problems ranging from climate change to air pollution. And in the short term it would help end the Muni meltdown by giving the system a much-needed infusion of cash, about $26 million per year, and more authority to manage its myriad problems.

The measure isn’t perfect. It would give a tremendous amount of power to the unelected Metropolitan Transportation Authority, a semiautonomous agency created in 1999 to reform Muni. But we also understand the arguments of Sup. Aaron Peskin — who wrote the measure in collaboration with labor and other groups — that the MTA is free to make tough decisions that someone facing reelection might avoid. And the measure still would give the Board of Supervisors authority to block the MTA’s budget, fare increases, and route changes with seven votes.

We’re also a little worried about provisions that could place the Taxicab Commission under the MTA’s purview and allow the agency to tinker with the medallion system and undermine Proposition K, the 1978 law that gives operating permits to working drivers, not corporations. Peskin promised us, on tape, that he will ensure, with legislation if necessary, that no such thing happens, and we’ll hold him to it.

Ultimately, the benefits of this measure outweigh our concerns. The fact that the labor movement has signed off on expanded management powers for the MTA shows how important this compromise is. The MTA would have the power to fully implement the impending recommendations in the city’s Transit Improvement Project study and would be held accountable for improvements to Muni’s on-time performance. New bonding authority under the measure would also give the MTA the ability to quickly pursue capital projects that would allow more people to comfortably use public transit.

The measure would also create an integrated transportation system combining everything from parking to cabs to bike lanes under one agency, which would then be mandated to find ways to roll back greenhouse gas emissions from transportation sources to 80 percent of 1990 levels by 2012. And to do that, the agency would get to keep all of the revenue generated by its new programs. As a side benefit — and another important reason to vote for Prop. A — approval of this measure would nullify the disastrous Proposition H on the same ballot.

San Francisco faces lots of tough choices if we’re going to minimize climate change and maximize the free flow of people through our landlocked city. Measure A is an important start. Vote yes.

Proposition B (commission holdovers)

YES


Proposition B is a simple good-government measure that ends a practice then-mayor Willie Brown developed into a science — allowing commissioners to continue serving after their terms expire, turning them into at-will appointments and assuring their loyalty.

Members of some of the most powerful commissions in town serve set four-year terms. The idea is to give the members, many appointed by the mayor, some degree of independence: they can’t be fired summarily for voting against the interests (or demands) of the chief executive.

But once their terms expire, the mayor can simply choose not to reappoint or replace them, leaving them in limbo for months, even years — and while they still sit on the commissions and vote, these holdover commissioners can be fired at any time. So their jobs depend, day by day, on the whims of the mayor.

Prop. B, sponsored by the progressives on the Board of Supervisors, simply would limit to 60 days the amount of time a commissioner can serve as a holdover. After that period, the person’s term would end, and he or she would have to step down. That would force the mayor to either reappoint or replace commissioners in a timely manner — and help give these powerful posts at least a chance at independence. Vote yes.

Proposition C (public hearings on proposed measures)

NO


Proposition C sure sounds good: it would mandate that the supervisors hold a hearing 45 days in advance before putting any measure on the ballot. The mayor would have to submit proposed ballot measures for hearings too. That would end the practice of last-minute legislation; since four supervisors can place any ordinance on the ballot (and the mayor can do the same), proposals that have never been vetted by the public and never subjected to any prior discussion often wind up before the voters. Sometimes that means the measures are poorly written and have unintended consequences.

But this really isn’t a good-government measure; it’s a move by the Chamber of Commerce and downtown to reduce the power of the district-elected supervisors.

The 1932 City Charter gave the supervisors the power to place items before the voters as a check on corruption. In San Francisco it’s been used as a check on downtown power. In 1986, for example, activists gathered enough voter signatures to place Proposition M, a landmark measure controlling downtown development, on the ballot. But then–city attorney Louise Renne, acting on behalf of downtown developers, used a ridiculous technicality to invalidate it. At the last minute, the activists were able to get four supervisors to sign on — and Prop. M, one of the most important pieces of progressive planning legislation in the history of San Francisco, ultimately won voter approval. Under Prop. C, that couldn’t have happened.

In theory, most of the time, anything that goes on the ballot should be subject to public hearings. Sometimes, as in the case of Prop. M, that’s not possible.

We recognize the frustration some groups (particularly small businesses) feel when legislation gets passed without any meaningful input from the people directly affected. But it doesn’t require a strict ballot measure like Prop. C to solve the problem. The supervisors should adopt rules mandating public hearings on propositions, but with a more flexible deadline and exemptions for emergencies. Meanwhile, vote no on Prop. C.

Proposition D (library preservation fund)

YES


In the 1980s and early 1990s, San Francisco mayors loved to cut the budget of the public library. Every time money was short — and money was chronically short — the library took a hit. It was an easy target. If you cut other departments (say, police or fire or Muni or public health), people would howl and say lives were in danger. Reducing the hours at a few neighborhood branch libraries didn’t seem nearly as dire.

So activists who argued that libraries were an essential public service put a measure on the ballot in 1994 that guaranteed at least a modest level of library funding. The improvements have been dramatic: branch library hours have increased more than 50 percent, library use is way up, there are more librarians around in the afternoons to help kids with their homework…. In that sense, the Library Preservation Fund has been a great success. The program is scheduled to sunset next year; Proposition D would extend it another 15 years.

If the current management of the public library system were a bit more trustworthy, this would be a no-brainer. Unfortunately, the library commission and staff have been resisting accountability; ironically, the library — a font of public information — makes it difficult to get basic records about library operations. The library is terrible about sunshine; in fact, activists have had to sue this year to get the library to respond to a simple public-records request (for nonconfidential information on repetitive stress injuries among library staff). And we’re not thrilled that a significant part of the library’s operating budget is raised (and controlled) by a private group, Friends of the San Francisco Public Library, which decides, with no oversight by an elected official, how as much as 10 percent of library money is spent.

But libraries are too valuable and too easy a budget target to allow the Library Preservation Fund to expire. And the way to fend off creeping privatization is hardly by starving a public institution for funds. So we’ll support Prop. D.

Proposition E (mayoral attendance at Board of Supervisors meetings)

YES, YES, YES


If it feels as though you’ve already voted on this, you have: last November, by a strong majority, San Franciscans approved a policy statement calling on the mayor to attend at least one Board of Supervisors meeting each month to answer questions and discuss policy. It’s a great idea, modeled on the very successful Question Time in the United Kingdom, under which the British prime minister appears before Parliament regularly and submits to questions from all political parties. Proposition E would force the mayor to comply. Newsom, despite his constant statements about respecting the will of the voters, has never once complied with the existing policy statement. Instead, he’s set up a series of phony neighborhood meetings at which he controls the agenda and personally selects which questions he’s going to answer.

We recognize that some supervisors would use the occasion of the mayor’s appearance to grandstand — but the mayor does that almost every day. Appearing before the board once a month isn’t an undue burden; in fact, it would probably help Newsom in the long run. If he’s going to seek higher office, he’s going to have to get used to tough questioning and learn to deal with critics in a forum he doesn’t control.

Beyond all the politics, this idea is good for the city. The mayor claims he already meets regularly with members of the board, but those meetings are private, behind closed doors. Hearing the mayor and the board argue about policy in public would be informative and educational and help frame serious policy debates. Besides, as Sup. Chris Daly says, with Newsom a lock for reelection, this is the only thing on the ballot that would help hold him accountable. Vote yes on Prop. E.

Proposition F (police pensions)

YES


We really didn’t want to endorse this measure. We’re sick and tired of the San Francisco Police Officers Association — which opposed violence-prevention funding, opposed foot patrols, opposes every new revenue measure, and bitterly, often viciously, opposes police accountability — coming around, tin cup in hand, every single election and asking progressives to vote to give the cops more money. San Francisco police officers deserve decent pay — it’s a tough, dangerous job — but the starting salary for a rookie cop in this town exceeds $60,000, the benefits are extraordinarily generous, and the San Francisco Police Department is well on its way to setting a record as the highest-paid police force in the country.

Now it wants more.

But in fact, Proposition F is pretty minor — it would affect only about 60 officers who were airport cops before the airport police were merged into the SFPD in 1997. Those cops have a different retirement system, which isn’t quite as good as what they would get with full SFPD benefits. We’re talking about $30,000 a year; in the end, it’s a simple labor issue, and we hate to blame a small group of officers in one division for the serious sins of their union and its leadership. So we’ll endorse Prop. F. But we have a message for the SFPOA’s president: if you want to beat up the progressives, reject new tax plans, promote secrecy, and fight accountability, don’t come down here again asking for big, expensive benefit improvements.

Proposition G (Golden Gate Park stables)

YES


This is an odd one: Proposition G, sponsored by Sup. Jake McGoldrick, would create a special fund for the renovation of the historic (and dilapidated) horse stables in Golden Gate Park. The city would match every $3 in private donations with $1 in public money, up to a total of $750,000. The city would leverage that money with $1.2 million in state funds available for the project and fix up the stables.

Supporters, including most of the progressive supervisors, say that the stables are a historic gem and that horseback riding in the park would provide "after-school, summer and weekend activities for families and youth." That might be a bit of a stretch — keeping horses is expensive, and riding almost certainly won’t be a free activity for anyone. But the stables have been the target of privatization efforts in the past and, under Newsom, almost certainly would be again in the future; this is exactly the sort of operation that the mayor would like to turn over to a private contractor. So for a modest $750,000, Prop. G would keep the stables in public hands. Sounds like a good deal to us. Vote yes.

Proposition H (reguutf8g parking spaces)

NO, NO, NO


It’s hard to overstate just how bad this measure is or to condemn strongly enough the sleazy and deceptive tactics that led Don Fisher, Webcor, and other downtown power brokers to buy the signatures that placed what they call "Parking for the Neighborhoods" on the ballot. That’s why Proposition H has been almost universally condemned, even by downtown’s allies in City Hall, and why Proposition A includes a provision that would negate Proposition H if both are approved.

Basically, this measure would wipe out three decades’ worth of environmentally sound planning policies in favor of giving every developer and homeowner the absolute right to build a parking space for every housing unit (or two spaces for every three units in the downtown core). While that basic idea might have some appeal to drivers with parking frustrations, even they should consider the disastrous implications of this greedy and shortsighted power grab.

The city has very little leverage to force developers to offer community benefits like open space or more affordable housing, or to design buildings that are attractive and environmentally friendly. But parking spots make housing more valuable (and expensive), so developers will help the city meet its needs in order to get them. That would end with this measure, just as the absolute right to parking would eliminate things like Muni stops and street trees while creating more driveways, which are dangerous to bicyclists and pedestrians. It would flip the equation to place developers’ desires over the public interest.

Worst of all, it would reverse the city’s transit-first policies in a way that ultimately would hurt drivers and property owners, the very people it is appealing to. If we don’t limit the number of parking spots that can be built with the 10,000 housing units slated for the downtown core, it will result in traffic gridlock that will lower property values and kill any chance of creating a world-class transit system.

But by then, the developers will be off counting our money, leaving us to clean up their mess. Don’t be fooled. Vote no.

Proposition I (Office of Small Business)

YES


Proposition I got on the ballot after small-business leaders tried unsuccessfully to get the supervisors to fund a modest program to create staff for the Small Business Commission and create a one-stop shop for small-business assistance and permitting. We don’t typically support this sort of after-the-fact ballot-box budgeting request, but we’re making an exception here.

San Francisco demands a lot from small businesses. It’s an expensive place to set up shop, and city taxes discriminate against them. We supported the new rules mandating that even small operations give paid days off and in many cases pay for health insurance, but we recognize that they put a burden on small businesses. And in the end, the little operators don’t get a whole lot back from City Hall.

This is a pretty minor request: it would allocate $750,000 to set up an Office of Small Business under the Small Business Commission. The funding would be for the first year only; after that the advocates would have to convince the supervisors that it was worth continuing. Small businesses are the economic and job-generation engines of San Francisco, and this one-time request for money that amounts to less than 1/10th of 1 percent of the city budget is worthy of support. Vote yes on Prop. I.

Proposition J (wireless Internet network)

NO


It’s going to be hard to convince people to vote against this measure; as one blogger put it, the mayor of San Francisco is offering free ice cream. Anyone want to decline?

Well, yes — decline is exactly what the voters should do. Because Proposition J’s promise of free and universal wireless Internet service is simply a fraud. And the way it’s worded would ensure that our local Internet infrastructure is handed over to a private company — a terrible idea.

For starters, San Francisco has already been down this road. Newsom worked out a deal a year ago with EarthLink and Google to provide free wi-fi. But the contract had all sorts of problems: the free access would have been too slow for a lot of uses, faster access wouldn’t have been free, there weren’t good privacy protections, and the network wouldn’t have been anything close to universal. Wi-fi signals don’t penetrate walls very well, and the signals in this plan wouldn’t have reached much above the second floor of a building — so anyone who lived in an interior space above the second floor (and that’s a lot of people) wouldn’t have gotten access at all.

So the supervisors asked a few questions and slowed things down — and it’s good they did, because EarthLink suddenly had a change in its business strategy and pulled out of citywide wi-fi altogether. That’s one of the problems with using a private partner for this sort of project: the city is subject to the marketing whims of tech companies that are constantly changing their strategies as the economic and technical issues of wi-fi evolve.

San Francisco needs a municipal Internet system; it ought to be part of the city’s public infrastructure, just like the streets, the buses, and the water and sewer lines. It shouldn’t rely just on a fickle technology like wi-fi either; it should be based on fiber-optic cables. Creating that network wouldn’t be all that expensive; EarthLink was going to do it for $10 million.

Prop. J is just a policy statement and would have no immediate impact. Still, it’s annoying and wrongheaded for the mayor to try to get San Franciscans to give a vote of confidence to a project that has already crashed and burned, and Sup. Aaron Peskin, the cosponsor, should never have put his name on it. Vote no.

Proposition K (ads on street furniture)

YES


San Francisco is awash in commercialism. With all of the billboards and ads, the city is starting to feel like a giant NASCAR racer. And a lot of them come from Clear Channel Communications, the giant, monopolistic broadcast outfit that controls radio stations, billboards, and now the contract to build new bus shelters in the city with even more ads on them.

Proposition K is a policy statement, sponsored by Sup. Jake McGoldrick, that seeks to bar any further expansion of street-furniture advertising in the city. That would mean no more deals with the likes of Clear Channel to allow more lighted kiosks with ads on them — and no more new bus shelter ads. That’s got Clear Channel agitated — the company just won the 15-year bid to rebuild the city’s existing 1,200 Muni shelters, and now it wants to add 380 more. Clear Channel argues that the city would get badly needed revenue for Muni from the expanded shelters; actually, the contract already guarantees Muni a large chunk of additional funding. And nothing in Prop. K would block Clear Channel from upgrading the existing shelters and plastering ads all over them.

On a basic philosophical level, we don’t support the idea of funding Muni by selling ads on the street, any more than we would support the idea of funding the Recreation and Park Department by selling the naming rights to the Hall of Flowers or the Japanese Tea Garden or the golf courses. On a practical level, the Clear Channel deal is dubious anyway: the company, which runs 10 mostly lousy radio stations in town and gives almost nothing of value to the community, refuses to provide the public with any information on its projected profits and losses, so there’s no way to tell if the income the city would get from the expanded shelters would be a fair share of the overall revenue.

Vote yes on K.

On the bright side

The most masterful crafters of fiction depend on the deliberate omission of details. Ernest Hemingway, in a 1958 interview with the Paris Review, called it the iceberg of a story, an eighth of which pierces the surface, known and visible, while an untold reality remains submerged beneath the narrative. This art of absentia served Hemingway well, layering his stories with nuance and mystery. The icebergs in Bjørn Lomborg’s Cool It: The Skeptical Environmentalist’s Guide to Global Warming serve their author’s purposes too, but they’re likely to melt under the glare of critical scrutiny.

Lomborg, a Danish statistician and adjunct professor at the Copenhagen Business School, examines the problem of climate change through the lens of expense, and according to his calculations, the public benefits of cutting carbon dioxide emissions aren’t worth the cost. If we really want to improve future conditions, he contends, we should pay more attention to social problems like hunger and disease, causes that have been relegated to the status of ugly stepchildren by the new hype around saving the climate. Early in the book he concludes that, calculated in purely economic terms, the Kyoto Protocol is a "bad deal." Every dollar spent cutting carbon emissions translates to 34 cents of "good" — a term he neglects to define.

Whatever his definition, it demands investigation. Lomborg is, after all, "the skeptical environmentalist," as he first made plain in 2001’s The Skeptical Environmentalist: Measuring the Real State of the World, which was roundly debunked by scientists and Lomborg’s avowed fellow environmentalists. The Union of Concerned Scientists got concerned with his optimism about the state of the natural world and convened a panel of leading experts, including biologist Edward O. Wilson, water expert Peter Gleick, and climate modeler Jerry Mahlman to delve into the details of his data. They determined that his conclusions were drawn from an artful manipulation of facts disguised by a narrative deftly criticizing other artful manipulators of facts.

In Cool It, Lomborg attempts to defame the doomsday scenarios presented by respected environmentalists and thinkers such as Al Gore, Bill McKibben, and James Hansen by focusing on their offal: the potential positive impacts of global warming. He points out that more people die from cold-related deaths than heat-related deaths and wonders why no one’s talking about the fact that fewer people may freeze to death in 2050.

Lomborg never denies that climate change is occurring, but he proffers interesting statistics to show that things aren’t as bad as has been reported, and he blames the media for distorting facts by employing easy iconography — hurricanes, Mount Kilimanjaro, polar bears, Antarctica. And it’s true: the media often go for the easy image — such as Time‘s cover photo of a polar bear bereft on a chunk of ice, which played a role in bringing the term "global warming" into the common vernacular. Lomborg, by the way, made that same magazine’s "100 most influential people" list in 2004.

This influential person writes with cool-headed assurance that global warming will not adversely affect polar bears any more than hunting them does, that some populations of them are actually increasing, and that evolution will equip the fittest for the future. He writes, "Yes, it is likely that disappearing ice will make it harder for polar bears to continue their traditional foraging patterns and that they will increasingly take up a lifestyle similar to that of brown bears, from which they evolved." His back-of-the-book footnote to that statement reads: "The Arctic Climate Impact Assessment finds it likely that disappearing ice will make polar bears take up a ‘terrestrial summer lifestyle similar to that of brown bears, from which they evolved.’ "

And the hawks begin to circle. In a recent interview with Lomborg, Salon.com’s Kevin Berger said, "But you edited the quote. The whole thing goes like this: ‘It is difficult to envisage the survival of polar bears as a species given a zero summer sea-ice scenario. Their only option would be a terrestrial summer lifestyle similar to that of brown bears, from which they evolved. In such a case, competition, risk of hybridization with brown bears and grizzly bears, and increased interactions with people would then number among the threats to polar bears.’ " Lomborg defends himself by saying he talked to a different expert.

While it would be easy to discredit the remainder of the book based on this exposé, there is some worth in Lomborg’s reminder that we’ve been asleep at the wheel on far too many social problems, such as clean water, hygiene, disease prevention, and hunger. He isn’t wrong when he says that solving them would better equip populations for dealing with climate change. But further tugging at the roots of his footnotes is almost unnecessary because Cool It is virtually devoid of fully explored ideas.

For example, at a 2004 meeting the Copenhagen Consensus Center, a consortium of economists headed by Lomborg that think tanks on global challenges, drew up a global priority list of issues we should be addressing rather than shuttling cash toward cutting CO2 emissions. Ranking third is increased trade liberalization — code language for more NAFTA-type agreements, which have proved detrimental to developing countries. And what exactly is meant by number five, "development of new agricultural technologies"? Genetically modified organisms? Newer, stronger, somehow nontoxic pesticides? It’s hard to believe an environmentalist might promote pesticide use, but in his chapter on eradicating malaria Lomborg writes, "Concerns from Western governments, nongovernmental organizations, and local populations make it hard to utilize DDT, which is still the most cost-effective insecticide against mosquitoes and, properly used, has negligible environmental impact."

Such a statement underscores Lomborg’s priorities when it comes to health — both human and environmental. His definition of cost gives primacy to cold, hard cash at the "negligible" expense of humans and their environments. Likewise, when the discussion turns to ratifying Kyoto, which he claims — without much explanation — would cost the US economy $160 billion a year, the price tag refers solely to the cost of disrupting business as usual.

"If we try to stabilize emissions, it turns out that for the first 170 years the costs are greater than the benefits," Lomborg writes. But for the past 200 years we’ve been doing business on the cheap — and that shouldn’t be our baseline cost of existence. What’s the true cost of a species? Do we really know until it’s gone? What about the other negative environmental impacts of business as usual? Or the positive impacts of, say, more public transit to reduce car trips to reduce emissions? Plus, a decrease in the burning of coal, oil, and natural gas means more than just a decrease in carbon emissions. It means less mining, less drilling, less invasion into remote or protected areas questing for new ores. It means fewer oil spills, less mountaintop removal, less ground, water, and air pollution for the communities that have the misfortune of being sited in the backyards of industry.

In the book’s conclusion, Lomborg pushes for a $25 billion investment in research and design for alternative technologies. Seven times cheaper than adopting the Kyoto Protocol or establishing a rigorous carbon tax to encourage less CO2 emission, R&D investments are, in Lomborg’s economic rubric, a better deal.

Of course, there are already operational solar panels, wind turbines, geothermal units, vehicle-to-grid electric cars, and biodiesel recipes that could be more aggressively produced and adopted. But in Lomborg’s eyes they’re too expensive, bound to be replaced by superior technology, and thus a waste of money, to invest in now — he brushes aside economists who contend that prices will drop as demand increases. And beyond offering no ideas on diminishing the use of fossil fuel, he in fact encourages burning more in the communities that aren’t yet — though the sole upside to fossil fuels is economic cost, and the only cap on price is the perception of abundance.

He also fails to acknowledge that we can’t have both. We can’t have an increase in alternative technologies and an unabated use of fossil fuels. To actually deploy alternative technologies in the market — the hoped-for end result of all that R&D — would require the fossil fuels to step aside. This would, in turn, cut CO2 emissions. One must necessarily replace the other. There isn’t room for both. It’s like trying to put ice in a glass that’s already brimming with cold water.

One could argue that any adoption of alternative technologies would cover increased use, but that ignores what numerous researchers have pointed out: we should be universally deploying simple, effective, already established energy-efficiency measures. For the past 30 years California has done this, and despite projections and escautf8g energy use nationwide, the state’s needs have only increased in lockstep with the population — about 1 percent a year. Lomborg doesn’t aggressively push for energy efficiency, despite its cost-savings popularity with the same economically driven corporations, governments, and individuals likely to elevate Cool It to biblical status.

Lomborg criticizes as too extreme and costly proposals by Tony Blair and Gore to slash CO2 emissions by 50 or 80 percent respectively. Similarly he writes, "Restricting transportation will make the economy less efficient. Cutting back on hot showers, plane trips, and car use will leave you less well-off. It will also reduce the number of people being saved from cold, it will increase the number of water stressed [people], and it will allow fewer to get rich enough to avoid malaria, starvation, and poverty."

Is it too bold to ask people to foreswear some of the excesses they’ve enjoyed, to put to bed some creature comforts, to fundamentally change the way they perceive living in the 21st century if they hope for a 22nd century for their children? Lomborg doesn’t ask these questions, so Cool It becomes more of a distraction than a contribution at a time when environmentalists should be busy promoting solutions, not debunking the carefully crafted fables of Lomborg’s dollar-driven theses. *

There are a handful of freedoms that have almost always been a part of American democracy. Even when they didn’t exactly apply to everyone or weren’t always protected by the people in charge, a few simple but significant rights have been patently clear in the Constitution: You can’t be nabbed by the cops and tossed behind bars without a reason. If you are imprisoned, you can’t be incarcerated indefinitely; you have the right to a speedy trial with a judge and jury. When that court date rolls around, you’ll be able to see the evidence against you.

The president can’t suspend elections, spy without warrants, or dispatch federal troops to trump local cops or quell protests. Nor can the commander in chief commence a witch hunt, deem individuals "enemy combatants," or shunt them into special tribunals outside the purview of our 218-year-old judicial system.

Until now. This year’s Project Censored presents a chilling portrait of a newly empowered executive branch signing away civil liberties for the sake of an endless and amorphous war on terror. And for the most part, the major news media weren’t paying attention.

"This year it seemed like civil rights just rose to the top," said Peter Phillips, the director of Project Censored, the annual media survey conducted by Sonoma State University researchers and students who spend the year patrolling obscure publications, national and international Web sites, and mainstream news outlets to compile the 25 most significant stories that were inadequately reported or essentially ignored.

While the project usually turns up a range of underreported issues, this year’s stories all fall somewhat neatly into two categories — the increase of privatization and the decrease of human rights. Some of the stories qualify as both.

"I think they indicate a very real concern about where our democracy is heading," writer and veteran judge Michael Parenti said.

For 31 years Project Censored has been compiling a list of the major stories that the nation’s news media have ignored, misreported, or poorly covered.

The Oxford American Dictionary defines censorship as "the practice of officially examining books, movies, etc., and suppressing unacceptable parts," which Phillips said is also a fine description of what happens under a dictatorship. When it comes to democracy, the black marker is a bit more nuanced. "We need to broaden our understanding of censorship," he said. After 11 years at the helm of Project Censored, Phillips thinks the most bowdlerizing force is the fourth estate itself: "The corporate media is complicit. There’s no excuse for the major media giants to be missing major news stories like this."

As the stories cited in this year’s Project Censored selections point out, the federal government continues to provide major news networks with stock footage, which is dutifully broadcast as news. The George W. Bush administration has spent more federal money than any other presidency on public relations. Without a doubt, Parenti said, the government invests in shaping our beliefs. "Every day they’re checking out what we think," he said. "The erosion of civil liberties is not happening in one fell swoop but in increments. Very consciously, this administration has been heading toward a general autocracy."

Carl Jensen, who founded Project Censored in 1976 after witnessing the landslide reelection of Richard Nixon in 1972 in spite of mounting evidence of the Watergate scandal, agreed that this year’s censored stories amount to an accumulated threat to democracy. "I’m waiting for one of our great liberal writers to put together the big picture of what’s going on here," he said.

1. GOOD-BYE, HABEAS CORPUS


The Military Commissions Act, passed in September 2006 as a last gasp of the Republican-controlled Congress and signed into law by Bush that Oct. 17, made significant changes to the nation’s judicial system.

The law allows the president to designate any person an "alien unlawful enemy combatant," shunting that individual into an alternative court system in which the writ of habeas corpus no longer applies, the right to a speedy trial is gone, and justice is meted out by a military tribunal that can admit evidence obtained through coercion and presented without the accused in the courtroom, all under the guise of preserving national security.

Habeas corpus, a constitutional right cribbed from the Magna Carta, protects against arbitrary imprisonment. Alexander Hamilton, writing in the Federalist Papers, called it the greatest defense against "the favorite and most formidable instruments of tyranny."

The Military Commissions Act has been seen mostly as a method for dealing with Guantánamo Bay detainees, and most journalists have reported that it doesn’t have any impact on Americans. On Oct. 19, 2006, editors at the New York Times wrote, in quite definitive language, "this law does not apply to American citizens."

Investigative journalist Robert Parry disagrees. The right of habeas corpus no longer exists for any of us, he wrote in the online journal Consortium. Deep down in the lower sections of the act, the language shifts from the very specific "alien unlawful enemy combatant" to the vague "any person subject to this chapter."

"Why does it contain language referring to ‘any person’ and then adding in an adjacent context a reference to people acting ‘in breach of allegiance or duty to the United States’?" Parry wrote. "Who has ‘an allegiance or duty to the United States’ if not an American citizen?"

Reached by phone, Parry told the Guardian that "this loose phraseology could be interpreted very narrowly or very broadly." He said he’s consulted with lawyers who are experienced in drafting federal security legislation, and they agreed that the "any person" terminology is troubling. "It could be fixed very simply, but the Bush administration put through this very vaguely worded law, and now there are a lot of differences of opinion on how it could be interpreted," Parry said.

Though US Sens. Patrick Leahy (D-Vt.) and Arlen Specter (R-Pa.) moved quickly to remedy the situation with the Habeas Corpus Restoration Act, that legislation has yet to pass Congress, which some suspect is because too many Democrats don’t want to seem soft on terrorism. Until tested by time, exactly how much the language of the Military Commissions Act may be manipulated will remain to be seen.

2. MARTIAL LAW: COMING TO A TOWN NEAR YOU


The Military Commissions Act was part of a one-two punch to civil liberties. While the first blow to habeas corpus received some attention, there was almost no media coverage of a private Oval Office ceremony held the same day the military act was signed at which Bush signed the John Warner Defense Authorization Act, a $532 billion catchall bill for defense spending.

Tucked away in the deeper recesses of that act, section 1076 allows the president to declare a public emergency and dispatch federal troops to take over National Guard units and local police if he determines them unfit for maintaining order. This is essentially a revival of the Insurrection Act, which was repealed by Congress in 1878, when it passed the Posse Comitatus Act in response to Northern troops overstaying their welcome in the reconstructed South. That act wiped out a potentially tyrannical amount of power by reinforcing the idea that the federal government should patrol the nation’s borders and let the states take care of their own territories.

The Warner act defines a public emergency as a "natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any state or possession of the United States" and extends its provisions to any place where "the president determines that domestic violence has occurred to such an extent that the constituted authorities of the state or possession are incapable of maintaining public order." On top of that, federal troops can be dispatched to "suppress, in a state, any insurrection, domestic violence, unlawful combination, or conspiracy."

So everything from a West Nile virus outbreak to a political protest could fall into the president’s personal definition of mayhem. That’s right — put your picket signs away.

The Warner act passed with 90 percent of the votes in the House and cleared the Senate unanimously. Months after its passage, Leahy was the only elected official to have publicly expressed concern about section 1076, warning his peers Sept. 19, 2006, that "we certainly do not need to make it easier for presidents to declare martial law. Invoking the Insurrection Act and using the military for law enforcement activities goes against some of the central tenets of our democracy. One can easily envision governors and mayors in charge of an emergency having to constantly look over their shoulders while someone who has never visited their communities gives the orders." In February, Leahy introduced Senate Bill 513 to repeal section 1076. It’s currently in the Armed Services Committee.

3. AFRICOM


President Jimmy Carter was the first to draw a clear line between America’s foreign policy and its concurrent "vital interest" in oil. During his 1980 State of the Union address, he said, "An attempt by any outside force to gain control of the Persian Gulf region will be regarded as an assault on the vital interests of the United States of America, and such an assault will be repelled by any means necessary, including military force."

Under what became the Carter Doctrine, an outpost of the Pentagon, called the United States Central Command, or CENTCOM, was established to ensure the uninterrupted flow of that slick "vital interest."

The United States is now constructing a similar permanent base in Africa, an area traditionally patrolled by more remote commands in Europe and the Pacific. No details have been released about exactly what AFRICOM’s operations and responsibilities will be or where troops will be located, though government spokespeople have vaguely stated that the mission is to establish order and keep peace for volatile governments — that just happen to be in oil-rich areas.

Though the official objective may be peace, some say the real desire is crude. "A new cold war is under way in Africa, and AFRICOM will be at the dark heart of it," Bryan Hunt wrote on the Moon of Alabama blog, which covers politics, economics, and philosophy. Most US oil imports come from African countries — in particular, Nigeria. According to the 2007 Congressional Budget Justification for Foreign Operations, "disruption of supply from Nigeria would represent a major blow to US oil-security strategy."

Though details of the AFRICOM strategy remain secret, Hunt has surveyed past governmental statements and reports by other independent journalists to draw parallels between AFRICOM and CENTCOM, making the case that the United States sees Africa as another "vital interest."

4. SECRET TRADE AGREEMENTS


As disappointing as the World Trade Organization has been, it has provided something of an open forum in which smaller countries can work together to demand concessions from larger, developed nations when brokering multilateral agreements.

At least in theory. The 2006 negotiations crumbled when the United States, the European Union, and Australia refused to heed India’s and Brazil’s demands for fair farm tariffs.

In the wake of that disaster, bilateral agreements have become the tactic of choice. These one-on-one negotiations, designed by the US and the EU, are cut like backroom deals, with the larger country bullying the smaller into agreements that couldn’t be reached through the WTO.

Bush administration officials, always quick with a charming moniker, are calling these free-trade agreements "competitive liberalization," and the EU considers them essential to negotiating future multilateral agreements.

But critics see them as fast tracks to increased foreign control of local resources in poor communities. "The overall effect of these changes in the rules is to progressively undermine economic governance, transferring power from governments to largely unaccountable multinational firms, robbing developing countries of the tools they need to develop their economies and gain a favorable foothold in global markets," states a report by Oxfam International, the antipoverty activist group.

5. SHANGHAIED SLAVES CONSTRUCT US EMBASSY IN IRAQ


Part of the permanent infrastructure the United States is erecting in Iraq includes the world’s largest embassy, built on Green Zone acreage equal to that of Vatican City. The $592 million job was awarded in 2005 to First Kuwaiti Trading and Contracting. Though much of the project’s management is staffed by Americans, most of the workers are from small or developing countries like the Philippines, India, and Pakistan and, according to David Phinney of CorpWatch — a Bay Area organization that investigates and exposes corporate environmental crimes, fraud, corruption, and violations of human rights — are recruited under false pretenses. At the airport, their boarding passes read Dubai. Their passports are stamped Dubai. But when they get off the plane, they’re in Baghdad.

Once on site, they’re often beaten and paid as little as $10 to $30 a day, CorpWatch concludes. Injured workers are dosed with heavy-duty painkillers and sent back on the job. Lodging is crowded, and food is substandard. One ex-foreman, who’s worked on five other US embassies around the world, said, "I’ve never seen a project more fucked up. Every US labor law was broken."

These workers have often been banned by their home countries from working in Baghdad because of unsafe conditions and flagging support for the war, but once they’re on Iraqi soil, protections are few. First, Kuwaiti managers take their passports, which is a violation of US labor laws. "If you don’t have a passport or an embassy to go to, what do you do to get out of a bad situation?" asked Rory Mayberry, a former medic for one of First Kuwaiti’s subcontractors, who blew the whistle on the squalid living conditions, medical malpractice, and general abuse he witnessed at the site.

The Pentagon has been investigating the slavelike conditions but has not released the names of any vioutf8g contractors or announced penalties. In the meantime, billions of dollars in contracts continue to be awarded to First Kuwaiti and other companies at which little accountability exists. As Phinney reported, "No journalist has ever been allowed access to the sprawling 104-acre site."

6. FALCON’S TALONS


Operation FALCON, or Federal and Local Cops Organized Nationally, is, in many ways, the manifestation of martial law forewarned by Frank Morales (see story 2). In an unprecedented partnership, more than 960 federal, state, and local police agencies teamed up in 2005 and 2006 to conduct the largest dragnet raids in US history. Armed with fistfuls of arrest warrants, they ran three separate raids around the country that netted 30,110 criminal arrests.

The Justice Department claimed the agents were targeting the "worst of the worst" criminals, and Attorney General Alberto Gonzales said, "Operation FALCON is an excellent example of President Bush’s direction and the Justice Department’s dedication to deal both with the terrorist threat and traditional violent crime."

However, as writer Mike Whitney points out on Uruknet.info, none of the suspects has been charged with anything related to terrorism. Additionally, while 30,110 individuals were arrested, only 586 firearms were found. That doesn’t sound very violent either.

Though the US Marshals Service has been quick to tally the offenses, Whitney says the numbers just don’t add up. For example, FALCON in 2006 captured 462 violent sex-crime suspects, 1,094 registered sex offenders, and 9,037 fugitives.

What about the other 7,481 people? "Who are they, and have they been charged with a crime?" Whitney asked.

The Marshals Service remains silent about these arrests. Whitney suggests those detainees may have been illegal immigrants and may be bound for border prisons currently being constructed by Halliburton (see last year’s Project Censored).

As an added bonus of complicity, the Justice Department supplied local news outlets with stock footage of the raids, which some TV stations ran accompanied by stories sourced from the Department of Justice’s news releases without any critical coverage of who exactly was swept up in the dragnets and where they are now.

7. BLACKWATER


The outsourcing of war has served two purposes for the Bush administration, which has given powerful corporations and private companies lucrative contracts supplying goods and services to American military operations overseas and quietly achieved an escalation of troops beyond what the public has been told or understands. Without actually deploying more military forces, the federal government instead contracts with private security firms like Blackwater to provide heavily armed details for US diplomats in Iraq, Afghanistan, and other countries where the nation is currently engaged in conflicts.

Blackwater is one of the more successful and well connected of the private companies profiting from the business of war. Started in 1996 by an ex–Navy Seal named Erik Prince, the North Carolina company employs 20,000 hired guns, training them on the world’s largest private military base.

"It’s become nothing short of the Praetorian Guard for the Bush administration’s so-called global war on terror," author Jeremy Scahill said on the Jan. 26 broadcast of the TV and radio news program Democracy Now! Scahill’s Blackwater: The Rise of the World’s Most Powerful Mercenary Army was published this year by Nation Books.

8. KIA: THE NEOLIBERAL INVASION OF INDIA


A March 2006 pact under which the United States agreed to supply nuclear fuel to India for the production of electric power also included a less-publicized corollary — the Knowledge Initiative on Agriculture. While it’s purportedly a deal to assist Indian farmers and liberalize trade (see story 4), critics say the initiative is destroying India’s local agrarian economy by encouraging the use of genetically modified seeds, which in turn is creating a new market for pesticides and driving up the overall cost of producing crops.

The deal provides a captive customer base for genetically modified seed maker Monsanto and a market for cheap goods to supply Wal-Mart, whose plans for 500 stores in the country could wipe out the livelihoods of 14 million small vendors.

Monsanto’s hybrid Bt cotton has already edged out local strains, and India is currently suffering an infestation of mealy bugs, which have proven immune to the pesticides the chemical companies have made available. Additionally, the sowing of crops has shifted from the traditional to the trade friendly. Farmers accustomed to cultivating mustard, a sacred local crop, are now producing soy, a plant foreign to India.

Though many farmers are seeing the folly of these deals, it’s often too late. Suicide has become a popular final act of opposition to what’s occurring in their country.

Vandana Shiva, who for 10 years has been studying the effects of bad trade deals on India, has published a report titled Seeds of Suicide, which recounts the deaths of more than 28,000 farmers who killed themselves in despair over the debts brought on them by binding agreements ultimately favoring corporations.

Hope comes in the form of a growing cadre of farmers hip to the flawed deals. They’ve organized into local sanghams, 72 of which now exist as small community networks that save and share seeds, skills, and assistance during the good times of harvest and the hard times of crop failure.

9. THE PRIVATIZATION OF AMERICA’S INFRASTRUCTURE


In 1956, President Dwight D. Eisenhower ushered through legislation for the greatest public works project in human history — the interstate highway system, 41,000 miles of roads funded almost entirely by the federal government.

Fifty years later many of those roads are in need of repair or replacement, but the federal government has not exactly risen to the challenge. Instead, more than 20 states have set up financial deals leasing the roads to private companies in exchange for repairs. These public-private partnerships are being lauded by politicians as the only credible financial solution to providing the public with improved services.

But opponents of all political stripes are criticizing the deals as theft of public property. They point out that the bulk of benefits is actually going to the private side of the equation — in many cases, to foreign companies with considerable experience building private roads in developing countries. In the United States these companies are entering into long-term leases of infrastructure like roads and bridges, for a low amount. They work out tax breaks to finance the repairs, raise tolls to cover the costs, and start realizing profits for their shareholders in as little as 10 years.

As Daniel Schulman and James Ridgeway reported in Mother Jones, "the Federal Highway Administration estimates that it will cost $50 billion a year above current levels of federal, state, and local highway funding to rehab existing bridges and roads over the next 16 years. Where to get that money, without raising taxes? Privatization promises a quick fix — and a way to outsource difficult decisions, like raising tolls, to entities that don’t have to worry about getting reelected."

The Indiana Toll Road, the Chicago Skyway, Virginia’s Pocahontas Parkway, and many other stretches of the nation’s public pavement have succumbed to these private deals.

Cheerleaders for privatization are deeply embedded in the Bush administration (see story 7), where they’ve been secretly fostering plans for a North American Free Trade Agreement superhighway, a 10-lane route set to run through the heart of the country and connect the Mexican and Canadian borders. It’s specifically designed to plug into the Mexican port of Lázaro Cárdenas, taking advantage of cheap labor by avoiding the International Longshore and Warehouse Union, whose members are traditionally tasked with unloading cargo, and the International Brotherhood of Teamsters, whose members transport that cargo that around the country.

10. VULTURE FUNDS: DEVOURING THE DESPERATE


Named for a bird that picks offal from a carcass, this financial scheme couldn’t be more aptly described. Well-endowed companies swoop in and purchase the debt owed by a third world country, then turn around and sue the country for the full amount — plus interest. In most courts, they win. Recently, Donegal International spent $3 million for $40 million worth of debt Zambia owed Romania, then sued for $55 million. In February an English court ruled that Zambia had to pay $15 million.

Often these countries are on the brink of having their debt relieved by the lenders in exchange for putting the owed money toward necessary goods and services for their citizens. But the vultures effectively initiate another round of deprivation for the impoverished countries by demanding full payment, and a loophole makes it legal.

Investigative reporter Greg Palast broke the story for the BBC’s Newsnight, saying that "the vultures have already sucked up about $1 billion in aid meant for the poorest nations, according to the World Bank in Washington."

With the exception of the BBC and Democracy Now!, no major news source has touched the story, though it’s incensed several members of Britain’s Parliament as well as the new prime minister, Gordon Brown. US Reps. John Conyers (D-Mich.) and Donald Payne (D-N.J.) lobbied Bush to take action as well, but political will may be elsewhere. Debt Advisory International, an investment consulting firm that’s been involved in several vulture funds that have generated millions in profits, is run by Paul Singer — the largest fundraiser for the Republican Party in the state of New York. He’s donated $1.7 million to Bush’s campaigns.

My best idea involved dressing like an FBI agent and waiting for old rich dudes to stealthily bust out their hash pipes; I’d let them get a couple of good hits, then jump out of the bushes, flash a fake badge, and demand to know who sold them the stuff. Pretty clever, right?

I had fun daydreaming about that scenario as I waded through the drug-addled, spotty-faced teenagers who had gathered on the trail leading into the heart of the park, where 50,000 other people were grooving to the eclectic and authentic sounds of the ’60s.

The random bits of conversation I overheard as I neared Speedway Meadow made me laugh even more. "Don’t eat the brown acid!" someone kept joking in his best Tommy Chong voice. "Hey, honey, I gotta go," I heard a man say into his cell phone. "I think Dan Hicks is starting." "Fucking perfect," I thought, and I congratulated myself and my entire generation for being more self-aware, fashionably astute, and cynical than the people gathered here.

But something was wrong: unlike the people at the festivals I normally attend, these folks were actually enjoying themselves, and they seemed to be enjoying one another’s company as well.

The music was great. I was having a good time. It was a really good show.

Maybe it was the combination of sun and beer. Maybe it was the smile I saw on everyone’s face. Who knows? The truth is, I suddenly realized that the only reason I ever attend music festivals is so I can more accurately think smug thoughts about others.

And as I looked around at all the happy souls, I realized that I, the cynical twentysomething, was seething with jealousy. "What are these people so happy about?" I thought. "Can’t they see that the world sucks?"

I began to wonder about the differences between my generation and the one that left its undeniable mark not only on Haight-Ashbury but also on the entire world. For all the problems of the ’60s, when these people congregated so long ago, they did it under their own steam and with purpose.

As the afternoon’s announcer put it, "Love is still better than hate, right? And isn’t peace still better than war?" Isn’t that all the hippies were trying to say? And what about my generation? What do we have to say about things? What have we ever done besides bitch and moan and ridicule and purchase? And what are we going to celebrate in 40 years? Bonnaroo, Coachella, Ozzfest, Rock the Bells, JuJu Beats? Are we really going to want to revisit this shit when we’re 60?

With the crowd growing rapidly, the sun shining brightly, and no way to escape without risking a DUI, I decided to put my misgivings aside and try to actually enjoy myself. I stuck a flower in my hair and made a beeline for the stage just as the announcer was introducing the New Riders of the Purple Sage. It took me half an hour, but I finally made it in time to catch Ray Manzarek and Rob Wasserman. As I sat and listened to what sounded like the Doors, I thought some more about the differences between the young people of now and then.

The truth is that I have never understood how the hippies did it. How did a bunch of college dropouts, artists, and poets suddenly commit to coming together in one place without having been seduced into doing so by a clever marketing campaign funded by huge corporations? Every gathering I’ve ever been to has cost me a fortune and lacked both unity and purpose. The Summer of Love was something different.

I sat for the next few hours listening to musicians like Country Joe McDonald, Taj Mahal, and members of the Steve Miller Band. They were all pretty good, but the highlight for me was hearing Lenore Kandel recite a love poem that would make Lil’ Kim blush.

As I made my way through the crowd to leave, I thought about the old joke I was going to start this piece with: How many hippies does it take to change a lightbulb? None, because hippies can’t change shit.

Well, the joke is on the joke. The people who celebrated the Summer of Love on Sept. 2 did change something — and even if they didn’t completely transform society, they were probably the last generation of young Americans to attempt to truly realize their vision of how the world should be. Anonymity trouble

TECHSPLOITATION Pundits of the Internet age are fond of excoriating the Web because anyone can post on it anonymously. Andrew Keen, whose recent book Cult of the Amateur is a good primer on why people hate the Web, highlights the horrors of anonymity in his work, contrasting the millions of unnamed Web scribblers with honorable, properly identified writers of yesteryear. Keen’s point is that people who don’t put their names on what they’ve written don’t feel responsible for it; therefore they feel little compunction about lying or misrepresenting their chosen subjects. After all, an anonymous writer doesn’t have to worry that their reputation will be tarred — unlike, say, a writer at the New York Times, whose byline appears on his or her articles.

Every social stereotype has a caricature associated with it, and the "anonymous Web writer" has theirs. They’re always portrayed as a he, first of all. And he’s inevitably described as being "some blogger writing in his basement in his pajamas." In other words, this anonymous person is not a professional (hence the pajamas) and probably poor (he lives in a basement). He’s a nobody, a loner who lashes out at the world from his dismal cell, hiding behind his anonymity and destroying the good reputations of nice people.

Where does this sad little man like to post his anonymous invective? Wikipedia, of course. He can change any entry without leaving his name, adding lies to biographies of innocent mayoral candidates and spewing spam all over facts. And the best part is that most people take Wikipedia seriously. They regard it as a reliable source of knowledge, despite the fact that it’s written by unknown, basement-dwelling bloggers in pajamas.

That’s why I was so gratified when California Institute of Technology grad student and mad scientist about town Virgil Griffith released his software tool Wikiscanner, which you can use to quickly check on who has been editing Wikipedia entries anonymously. You see, whenever you edit a Wikipedia entry, the encyclopedia logs your unique IP address, which can often be tracked back to a physical location, including your place of employment. Even if you think you’re being stealthy with your anonymous writing, you’re not. Wikipedia sees all.

And now the public can see all if they visit Griffith’s Wikiscanner site (wikiscanner.virgil.gr). Turns out that all the anonymous propaganda and lies on Wikipedia aren’t coming from basement dwellers at all — they’re coming from Congress, the CIA, the New York Times, the Washington Post, and the American Civil Liberties Union. Somebody at Halliburton deleted key information from an entry on war crimes; Diebold, an electronic-voting machine manufacturer, deleted sections of its entry about a lawsuit filed against it. Someone at Pepsi deleted information about health problems caused by the soft drink. Somebody at the New York Times deleted huge chunks of information from the entry on the Wall Street Journal. And of course, the CIA has been editing the entry on the Iraq war.

Wikiscanner allows you to search millions of edits, perusing a precise record of all the changes that have been made. While you can’t figure out exactly who at the CIA made the changes to the entry on the Iraq war, you can be sure the changes came from somebody on the CIA’s computer network.

Griffith created Wikiscanner for a frankly political reason. As he told the Times of London, he did it "to create minor public relations disasters for companies and organizations I dislike." In the process, however, he’s revealed something far more fundamental than the fact that acolytes of Pepsi and the CIA will stop at nothing to propagandize on behalf of their employers: he’s undermined the myth of the anonymous blogger in the basement.

It turns out that the people who are hiding behind anonymity online for nefarious or selfish reasons are not little guys in pajamas but the very bastions of accountability that haters of the Web have deified. It’s not a mean dude with a grudge who is spreading lies on Wikipedia but rather a member of the federal government or a journalist at the New York Times. Cultural anarchy online is coming not from the hordes of scribbling bloggers but from the same entities that have always posed a danger to culture: corporations and governments who refuse to take responsibility for what they’re doing.<\!s>*

I love it. Really! Congress has just voted in a basic legal carte blanche for the Administration to spy on Americans’ emails and phone convos without any court review. Ostensibly, the new law is only to target foreigners who talk to Americans by allowing the government to tap into fiber optic networks based in the US (previously they could only tap into those based on foreign soil) — and the Administration promises — PROMISES — not to use any tips obtained this way to go after Americans on the one end of the conversation. I believe them! Only foreigners are terrorists anyway (sorry, Oklahoma).

The best parts?

*Telecommunications companies must obey the government on this. No more of those pesky legal challenges from the more skeptical among them that were gumming up the spyworks. And no more of that free market hooey from our overlords. Just make the corporations do what you want. Terror!

*Bye-bye to FISA, the oversight court set up in the ’70s in reaction to Nixonian dirty tricks re: domestic spying. Guess who gets final approval on who gets spied on when? ALBERTO GONZALES. Guess all that lying and “misremembering” and total dereliction of basic duty evidenced when he was in the congressional hotseats — what, three times in the past 3 months? — convinced Congress that he should be in charge of the nation’s privacy. Way to go Alberto! I’ve GOT to try your tactics in my own career.

Remind me why I was happy about the Dems taking Congress again? WTF?

There’s a new move afoot, this time through a lawsuit, to change the way taxicab permits work in San Francisco. Rachel Stern lays out the story on page 14, but allow me to offer a bit of political background:

The San Francisco cab industry works as a medieval class system. There are members of the landed gentry — people who have medallions, or operating permits — and there are serfs, people who drive cabs but don’t have permits. The serfs fork over a significant portion of their income every day to the gentry in the form of lease fees, the same way the peasants used to fork over much of their income for the right to live near a castle or hunt or farm on the gentry’s land. See, you can’t drive a cab without a permit, and if you don’t have one, you have to lease one from someone who does.

Drivers are all independent contractors, so they get no health insurance or disability and retirement benefits.

In this particular economic world, even the permit holders aren’t getting rich. The only ones who really make out are the top royalty, the cab companies themselves. But the gentry do a lot better than the serfs.

What’s interesting, though, and wonderful in its way, is that thanks to a 1978 law backed by that well-known Marxist former supervisor Quentin Kopp, you can’t inherit your way into the landed gentry. You can’t buy your way in, borrow your way in, or marry your way in. The only way to become a medallion holder is to put your name on a list and wait, along with all the other serfs, until, after 15 years or so, a permit opens up.

And the way a permits opens up is that someone who has one quits driving.

That’s the deal Kopp put together: only active, working drivers are supposed to get the benefits of the medallions. No corporations, no partnerships, no trusts, no relatives…. You personally drive a cab 800 hours a year, and you’re eligible to lease your permit out during those shifts when you’re not using it.

Of course, once a driver becomes a member of the landed gentry, he or she never wants to give up that permit. It’s free income, maybe worth $2,000 a month. The Medallion Holders Association desperately wants its members to be able to keep their permits when they retire, or be able to give them to their kids, or somehow cement them as property that a person can own, just like the forests and fields of the landed gentry of yore.

The latest issue is disability. Suppose you wait patiently for 15 years, suffering in serfdom, and your number finally comes up, and you get that golden ticket — and then you get in an accident and lose the ability to drive a car. I get the point; maybe there ought to be some transition program or something. But every time a nondriver gets to keep a permit, a serf waits even longer in line, forking over hundreds of dollars to a member of the gentry who doesn’t want to play by the rules anymore.

The bottom line is, cab permits belong to the city, and they aren’t supposed to be someone’s retirement fund. I don’t like any sort of rigid class system, but if you’re going to have one, the serfs deserve fairness too.<\!s>*

Who’s behind the wheel?

In 1997, Dirk, a taxi driver of 20 years, was stabbed in the neck by a hitchhiker he picked up after his last shift. Ten years later, blind and brain damaged because of the loss of blood, he still receives income of roughly $1,800 a month from his taxi medallion.

Under city law, he’s supposed to be driving.

Medallions are among the most prized — and disputed — permits in town. The city owns all 1,381 of the medallions, which allow the holders to operate taxis. But under a 1978 law known as Proposition K, only active drivers — later defined as people who put in an annual minimum of 800 hours behind the wheel — are eligible to hold the permits.

The medallion holders have a lucrative deal: when they aren’t driving, they can lease out the permits to other drivers. And since a lot of cabs are on the road 24 hours a day 365 days a year, those lease fees can add up.

Not surprisingly, there’s been some abuse over the years. You get a permit by putting your name on a list and waiting as long as 15 years. Some people who haven’t driven in years — people who don’t even live in the area — have risen to the top of the list, seized medallions, and pocketed the cash, hoping nobody would notice.

Recently, though, the city’s Taxicab Commission has been cracking down — and that has put people like Dirk in limbo and raised a series of political and legal questions that go to the heart of the city’s cab-permit system:

Does a disabled driver have a right to keep his or her medallion? Is it cruel to simply yank the permit — and the income — from somebody who may have been injured in the line of work? Or is allowing nondrivers to keep their medallions unfair to the thousands of working cabbies who are paying $91.50 a shift to lease a permitted cab and waiting in line for a permit to open up?

What right should someone who gets a valuable city permit, at no cost, have to keep using that permit to earn income when he or she no longer meets the permit requirements?

Taxicab Commission executive director Heidi Machen says the answers are straightforward. "Permit holders who are not meeting their requirements are abusing a public permit," she told the Guardian. "Proposition K was never set up as a retirement plan."

Joe Breall and Elliot Myles disagree — and they’re taking the issue to court in a case that could have lasting implications for the city’s taxicab industry, medallion holders, and other drivers.

The two Bay Area lawyers filed a class action lawsuit against the Taxicab Commission on June 25 on behalf of an estimated 150 disabled drivers who hold taxi medallions in the city. They argue that the driving requirement violates the 1990 Americans with Disabilities Act.

"These are long-term drivers who have a disability that simply does not allow them to drive now," said Breall, who represents National Cab Co.

One of the case’s two named plaintiffs, William Slone, is a medallion holder with a lung disease that requires him to be hooked up to an oxygen tank 24 hours a day. The other, Michael Merrithew, has a physical disability so severe that he cannot operate his taxi.

Machen has hired two investigators to crack down on medallion holders who are not fulfilling their requirements — whether a scofflaw is a healthy 30-year-old woman living in Hawaii but reaping her medallion’s profits or an elderly man who must use a wheelchair but is still using the medallion as his source of income.

"The ADA does not require a public agency to waive an essential eligibility requirement for a government program or benefit," Machen wrote in a memo dated Feb. 16, 2006.

The Taxicab Commission isn’t just yanking permits from anyone who gets hurt. Under its current policy, temporarily disabled medallion holders can apply to take one year off every five years and receive a 120-day driving exemption in each of the three years following that disability leave.

But the lawsuit argues that this policy "effectively sanctions all taxicab permit/medallion holders with disabilities other than temporary illness that prevent or substantially limit their ability to drive taxi cabs personally."

The lawsuit argues that disabled permit holders, under the ADA, should be relieved of the full-time driving requirement until their disabilities are medically resolved. In the case of some drivers, that could effectively give them use of city-owned medallions free, for life.

TRICKY ENFORCEMENT


Prop. K was written by recently retired San Mateo Superior Court judge Quentin Kopp, who was then a city supervisor. Kopp told us that permits were being bought and sold for hundreds of thousands of dollars and working drivers couldn’t afford them. The system, which is fairly unusual, was designed to ensure that cabbies — not investors, corporations, or speculators — got the benefits of the city-owned permits.

So Prop. K required that a permit be returned to city and passed on to the next person on the long waiting list if the holder stops driving. Other large cities, such as New York, still maintain a system in which permits may be auctioned off instead of being publicly owned.

The 941 post–<\d>Prop. K medallion holders, Machen said, can receive $1,800 to $3,000 a month for leasing their permits. There are roughly 6,000 taxi drivers in the city; a full-time cab driver makes about $24,000 a year, but those full-timers with permits can add another $20,000 or more to their income by leasing.

"It’s a city permit. If someone stops using it, it reverts to the city," Kopp told us. "There’s no provision for a grace period or something of that sort. Seven times voters rejected efforts to appeal or change it."

In fact, in 2003 voters overwhelmingly rejected a measure that would have allowed disabled drivers to keep their permits.

Elliott Myles of Oakland’s Myles Law Firm, which handles disability cases, told us that Prop. K is "irrelevant."

"The obligation to modify or waive comes from the ADA, a federal law binding on the commission," he wrote in an e-mail.

Although Kopp says Prop. K was intended to ensure that only active drivers get permits, the 800-hours-a-year rule isn’t in the law. Specific driving rules were added to the city’s Police Code in 1988.

And enforcement of the law has changed in the past few years. When the Taxicab Commission revoked the medallion of disabled driver Querida Mia Rivera in 2003, the decision was overturned by the Board of Appeals on the grounds that it violated the rights of Rivera — who had driven for 35 years before needing a wheelchair and becoming legally blind — under the ADA.

In response to the reversal, then-director Naomi Little implemented a policy to accommodate both temporarily and permanently disabled medallion holders, which paralleled the city’s catastrophic-injury program. This meant the modification or waiver of the 800 hours was overseen by the Department of Public Health.

"A disabled permit holder may apply for a waiver or reduction of the driving requirement, and the waiver or reduction, in appropriate cases, may be renewed on a yearly basis," Little wrote in a memorandum to Sup. Jake McGoldrick on July 30, 2003.

But in February 2006 the Taxicab Commission adopted Resolution 2006-28, which returned the city to the policy of strictly following the letter of Prop. K (although the panel allows temporary reprieves for people who are injured but could return to driving).

Michael Kwok, a former commission staffer who oversaw disability requests, said such a policy allows the permit waiting line to move faster.

Allowing a permanently disabled person to retain his or her permit is "not fair to the public," said Kwok, who uses a wheelchair. "It’s case by case."

The result is an enforcement process that can be tricky, to say the least.

On Aug. 17, 2004, for example, a physician wrote to the commission arguing that a disabled driver who was "suffering from failing eyesight and dizziness" and occasional arthritis in his hands should be taken off the road. "Please release him from taxi driving effective immediately for public safety," the doctor wrote. "He is advised not to drive a taxi as soon as possible."

Commission staffer Tristan Bettencourt, who was overseeing ADA compliance at the time, responded by reducing the driver’s yearly driving requirement to 400 hours, or 78 four-hour shifts, over the next year.

That could have left an unsafe driver on the road, Myles said.

"I find this reprehensible," he told us. "In most medical-injury suits, evidence of medical condition can only be given by qualified health care professionals."

Bettencourt, who left his job last year, said the Taxicab Commission shouldn’t be deciding whether someone is fit to drive or not. "We didn’t give out driver’s licenses," he told us. "If you hold a driver’s license, someone from the Department of Motor Vehicles has certified you."

According to Jan Mendoza, a public information officer at the DMV, a license needs to be renewed every five years — a process that can take place online if a person has a clean record. People over the age of 70, however, have to visit the office in person to take both a vision and a driving test.

Taxi drivers should not have any guarantee of lifetime entitlement, Bettencourt said. He added that the lack of a safety net for people who lose their means of employment is not something a San Francisco taxi regulator can solve; it’s a national problem.

EXIT STRATEGY?


Thomas George-Williams, who chairs the United Taxicab Workers, looks at the issue from the perspective of drivers who don’t have permits — the ones he considers second-class citizens in a two-tier system.

All San Francisco cab drivers are effectively independent contractors who are responsible for their own disability and retirement funds. And the drivers who don’t have permits get no benefits from the system at all.

Medallion holders "use the income of their medallions for disability insurance," George-Williams told us. "We need an exit strategy for all drivers, including medallion holders, and we don’t have that."

Charles Rathbone, a driver for 30 years and a medallion holder for 10, points to the harsh truth: there’s a key difference between the two cabbie classifications. "For drivers without medallions, there’s nothing to revoke," he told us.

Rathbone, a member of the Medallion Holders Association, spoke at the Taxicab Commission meeting July 13 to lay out two steps he felt the city should take before revoking a permit. He asked for two weeks’ advance warning and an appeals process.

"When I become disabled, I don’t want my only exit strategy to be a kick in the ass from the taxi commission," Rathbone later told us.

His speech was spurred by the June suicide of Lindsey Welcome, a 61-year-old medallion holder of 10 years who had not driven for seven of those years due to severe muscular dystrophy. Welcome’s medallion, which she leased out through Luxor Cabs, was scheduled to be revoked at the Taxicab Commission’s June 26 meeting.

"Her medallion was her only means of support," Kathleen Young, Welcome’s friend of 30 years, told us.

Rathbone feels many disabled medallion holders hide their disabilities for fear of the consequences, endangering themselves and the public.

One of the more severe recent taxi incidents happened March 26, 2003, when a 68-year-old permit holder crashed into a Market Street ATM, badly injuring a pedestrian and immobilizing two others.

"Too many people are driving when they shouldn’t be," said Bettina Cohen, Rathbone’s wife and editor of the MHA newsletter, which publicized the pending disability lawsuit on its front page last month.

Allowing disabled drivers to keep their permits may have its own downside: Carl Macmurdo, president of the MHA, acknowledged that the long waiting line for medallions means people will acquire them later in life and so will often be able to fully enjoy them for only a short time.

"[The city’s] giving permits to 70-year-olds and then taking them back," Macmurdo, who waited 13 years to get his permit, said.

Myles shared similar sentiments. "Every permit holder, just like every person, runs the risk of disability," he told us. "This question [of the disabled holding on to their permits] affects not only every current permit holder but every driver who is waiting in line to get a permit in the future."<\!s>*

Importing injustice

More than 100 tractor trailers were lined up at 6:30 a.m., inching toward the Port of Oakland’s Terminal 7, waiting for their next load. Against the backdrop of the San Francisco skyline, a mammoth freight ship emblazoned with the name Hyundai glided toward the port, pregnant with multicolor shipping containers.

A driver told the Guardian that he expected to be in line for at least two hours waiting to drop off the empty container attached to his big rig. His 1989 truck lacks air-conditioning, so the windows were rolled down, allowing diesel exhaust to pollute the air he was breathing.

It’s the same scene at many of the port’s other terminals: long lines of ancient trucks slowly snaking toward their destinations, their primarily immigrant drivers performing the essential and thankless task of transporting cheap clothes from Asia to the nation’s big-box retailers or helping to export California’s agricultural goods to Hawaii.

The fourth-busiest container port in the nation, the Port of Oakland is the economic engine of the region, providing thousands of jobs and more than $1 billion in revenue. But activists say that the port system has also led to sweatshoplike conditions for truckers and created a health crisis for the surrounding community.

On their poverty-level wages, truckers are usually able to buy only the oldest, most polluting trucks. Their diesel pollution is a major factor driving asthma rates through the roof in the neighboring, primarily African American neighborhood of West Oakland, where, the American Lung Association says, one in every five kids has asthma.

A new national coalition of labor, environmental, and community activists has advanced a proposal that would make all drivers employees with benefits, radically changing the way work is done on the waterfront and possibly heralding the return of the Teamsters to the ports for the first time in more than 20 years. In the process, the proposal would make the port’s biggest customers responsible for its environmental problems.

The coalition places the blame for the current situation squarely on giant retail shippers such as Wal-Mart and Target and is calling for them to be held accountable for the full environmental and labor costs of the cheap goods they sell — a call the corporations are strenuously resisting. The American Trucking Association, whose members contract directly with the corporation, has threatened a lawsuit if the change is adopted. But port officials have voiced a willingness to seriously consider implementing the proposal.

Having long claimed that the trucking industry is outside its control, the Port of Oakland could embrace the proposal as a means of satisfying community, environmental, political, and business concerns. With impending directives to clean the air coming from Sacramento, trade planned to almost double by 2020, two new Port Commission appointees representing labor and environmental concerns, and a federal antiterrorism tracking plan slated for this fall, the port is poised to play a leadership role that could reverberate up and down the West Coast and across the country.

THE TRUCKER’S LIFE


The Port of Oakland’s estimated 1,500 to 2,500 drivers are a far cry from the middle-class, long-haul Teamsters and the Smokey and the Bandit–<\d>style freewheeling rebels who have long been engrained in the American imagination. Instead, they are at the bottom of the port’s food chain and are the most exploited trucking sector in the country, consisting primarily of recent immigrants struggling to make ends meet.

Dawit Fre, 39, immigrated to Oakland from the small nation of Eritrea two years ago. "I wanted to see a better life," he told us. Fre was a driver in Africa and went to work for the Port of Oakland after his cousin told him people start their trucking careers there. He said he works up to 60 hours a week for one company, making the equivalent of about $8 an hour after expenses.

Fre arrives at work every day no later than 6:30 a.m., waits for dispatches from his company, and spends a minimum of two hours in line for each container he picks up or drops off. He is paid $42 for each load by the company. He doesn’t know how much the trucking companies make but has heard that some get $200 per load. He returns home around 6:30 at night.

"The whole time I’m at the port, I’m thinking about my family," he said. "I got children. The only thing I’m thinking inside the terminal is, how many moves am I going to do? Am I going to do four or five or three or two?"

On a good day he can get four, on a bad day as few as one, depending on the length of the lines and the generosity of the dispatcher. Then there are his expenses. As an independent operator, Fre is solely responsible for a tankful of diesel that costs him up to $250 a pop. DMV registration is $178 a month, and 12 percent of his weekly earnings goes to his boss for insurance on his truck, not to mention annual federal income tax.

He receives no benefits, no overtime pay, and no health care coverage at a time when his wife, a diabetic, is suffering from severe stomach complications. "I’m taking her to Highland Hospital," he told us. "If it’s easy for them to fix, they can do it. But if she has a big problem, they can’t do it."

Fre has his own health problems. "Most of the drivers, we have old trucks," he said. "You don’t have AC, your windows are down, and you get sick in the truck" from the diesel. Fre’s remedy for his persistent coughing and the burning in his throat is several glasses of milk after each day of work.

A 1998 study published in the Journal of Independent Medicine found that truck drivers face a risk of cancer 10 times greater than Occupational Safety and Health Administration–acceptable levels, and a 1990 study published in the American Journal of Public Health showed that truckers face nearly double the average lifetime lung cancer risk.

Fre has little money to invest in his truck, a ragged 1987 model that he said needs $5,000 in repairs. He doesn’t trust it on the freeway, so he’s asked his dispatcher to send him only from pier to pier, not outside the port, further dipping into his earnings. "I came here to see a better life," he said. "When I got here, I found it is different. Here we don’t get paid for the overtime. We don’t get benefits. When I get into the terminal, there is no respect."

His experience is typical of those of port truckers across the country. A study by the East Bay Alliance for a Sustainable Economy, a labor-affiliated think tank, found that the average Port of Oakland trucker makes as little as $8 an hour after expenses, works 11 hours a day, and spends two and a half hours in line per load. Almost none of the truckers reported receiving benefits on the job, and 66 percent don’t have health insurance.

This is consistent with data from a 2004 survey of port truckers in Los Angeles and Long Beach, conducted by a professor of economics at California State University Long Beach. That report found they had a median income of $25,000 a year after expenses and an average workday of 11.2 hours, with up to 33 percent of their time spent waiting in line.

Port truckers generally drive only the oldest, most polluting trucks because that’s all they can afford. An industry adage is that ports are "the place trucks go to die," a reality that has dire impacts on the surrounding communities.

POLLUTING THE COMMUNITY


West Oakland has long been a dumping ground for the Bay Area’s toxic waste. The community has one of the five highest asthma hospitalization rates in California, with an estimated 20 percent of its K–<\d>12 students suffering from the disorder, according to the ALA. Researchers at the University of Southern California have found that children living within a few hundred meters of freeways leading out of ports not only are more likely to suffer from asthma but also actually develop smaller lungs.

Margaret Gordon, a 60-year-old community health activist who has lived just blocks from the Port of Oakland for 15 years, told us that she and four of her grandchildren living with her all suffer from asthma. When one grandchild was born with severe asthma and her own asthma worsened after she moved to West Oakland, Gordon, then a housekeeper, started reading about the causes of asthma and made the connection to the port. Like many in the low-income neighborhood, she cannot afford to move elsewhere in the Bay Area.

Gordon has been fighting for clean air for more than a decade, and in April she was inducted into the Alameda County Women’s Hall of Fame for her work. In 2001, Gordon formed the West Oakland Environmental Indicators Project, which she now cochairs. The project has released more than half a dozen studies related to air quality. A 2003 report showed that trucks traveling through West Oakland in one day produce the same amount of toxic soot as 127,677 cars, leading to indoor air in some neighborhood homes that is five times more toxic than that in other parts of the city.

Still, Gordon told us that port officials are "only starting paying attention." Last year the California Air Resources Board passed a resolution related to air quality at ports and announced that it was developing a regulatory mechanism. A 2006 CARB report found that truck diesel exhaust accounts for the majority of the estimated 2,400 deaths related to freight transport each year and 70 percent of the state’s air pollution–<\d>related cancer risk. Freight transport will cost California residents $200 billion in health costs over the next 15 years. Most of this is borne by low-income communities of color near freight transport hubs.

The combination of state mandates and local community concerns is starting to spark a change. "They would sit down and talk with us before that, but there was not anything concrete done," Gordon told us. The port is now in the early planning stages of an air-quality-improvement program, working with Gordon and other activists.

That movement is getting vigorous new support from the Coalition for Clean and Safe Ports, a national partnership of labor, environmental, and community activists organizing at the country’s major container ports: Los Angeles, Long Beach, Miami, Oakland, New York–New Jersey, and Seattle.

"Every one of those ports has the same environmental and labor problems we have in Oakland," Doug Bloch, the coordinator for the coalition in Oakland, told us during a tour of the port’s heavy industrial landscape. Virtually all of its 900 maritime acres are covered by concrete and asphalt, monster cranes that inspired Star Wars‘ Imperial Walkers, and 20-foot steel containers stacked up like Legos behind chain-link fences.

The Port of Oakland has no direct relationship with its truckers at the present. Shippers take price bids from among roughly 100 trucking companies at the port, then contract the work to the independent-contractor truckers. The CCSP says bidding wars lead to poverty wages for truckers, older trucks and more pollution, and a chaotic port full of inefficiencies like long pickup waits.

Under the proposed system, ports would call on their ability as landlords to set standards for the trucking and shipping companies. They would require trucking companies to hire drivers as employees, shifting maintenance costs from the drivers to the companies, which would retrofit or replace all port trucks with more environmentally friendly rigs. The ports would allow only new, cleaner trucks to enter. The companies could then, in theory, pass the costs on to shippers and end users.

If drivers were paid as employees by the hour instead of by the trip, the coalition expects the market would reduce inefficient truck wait times and air pollution.

"When you rent an apartment you sign a lease," Bloch told us. "If you trash the place, you get evicted. Corporations are trashing this community, but they’re not being evicted."

A test case could soon be under way at the ports of Los Angeles and Long Beach, the two largest in the United States, and the situation is being closely watched by ports and industries across the country. Port commissioners there had hoped by the end of this month to approve the coalition’s program, which they expect to reduce diesel truck emissions by as much as 80 percent over the next five years. But growing opposition and the threat of lawsuits by groups like the California Trucking Association, which represents the owners of truck companies, and the Waterfront Coalition, a consortium of major retailers, led the ports to delay their decision. The commissioners now expect to vote in September after completing an economic impact survey.

At the center of the storm is the fact that as employees, truckers would be able to organize and form a union. As independent contractors, they are barred from doing so because of antitrust laws originally created to oppose vast enterprises that dominated industries. (A further irony is that giant retail steamship companies have experienced incredible consolidation and enjoy a limited antitrust immunity.)

If passed by LA port officials, the plan would be implemented there starting Jan. 1, 2008, and could result in a domino effect at the other, smaller ports across the country. "The industry is fighting like hell in LA," Bloch told us. "They know that if they’re going to have to pay, the party’s over."

Meanwhile, Bloch told us that more than 1,000 truckers have signed a petition asking the Port of Oakland to pass a version of the coalition’s proposal, and it will be presented to the Port Commission, the seven-member body that would eventually vote on the proposal. Spokesperson Libby Schaff told us that the port "agrees with the coalition that the port can and should have a more direct relationship with its truckers" and is "very seriously considering the coalition’s proposal."

Because the proposal "constitutes a major overhaul of the way trucking is done today," Schaff said the port is currently holding stakeholder meetings with residents, truckers, terminal operators, elected officials, the business community, and labor to consider it in the context of a more comprehensive port plan. Schaff said a comprehensive plan could be crafted in less than a year.

The port has not taken a position on granting truckers employee status. It is also looking into other funding mechanisms for a clean-truck program, including money from a pending state bill that would impose a $30 fee on every 20-foot-equivalent unit passing through the Los Angeles, Long Beach, and Oakland port complexes, to be used for improvements in road and rail infrastructure and for clean-air programs.

The legislation, Senate Bill 974, by Alan Lowenthal (D–Long Beach), would generate more than $525 million annually. But it faces tough opposition from some very powerful interests.

RESISTING CHANGE


Bill Aboudi, president of Oakland’s AB Trucking and a member of the CTA, told us truckers are "treated like second-class citizens," and he believes long lines and trucker asthma are serious problems. But he strongly opposes the coalition’s proposal. Instead, he told us, state regulations like those forthcoming from CARB and other piecemeal reforms are the answer.

"The coalition’s main goal is to unionize the drivers," Aboudi said. He was wearing a baseball cap emblazoned with two American flags and the words "Oakland Trucker." An immigrant from Israel, he has been at the Port of Oakland since 1992. "If these guys choose to be owner-operators, why are you rocking the boat? You can’t be playing with my livelihood just because you want to get union dues," Aboudi said. "Truckers want to own a piece of the American dream. They want to own their own truck."

It’s an appealing image to many. Kevin Leonard, an owner-operator trucker who contracts with Aboudi and others, told us he doesn’t want to give up his independent status. "I have the freedom to work when I want," he said. "I don’t see how the Teamsters can represent me better than I can."

The trucking industry as a whole says the coalition plan will force away trade and drive out small trucking companies, which will have to maintain the trucks and start paying benefits such as health insurance and workers’ compensation.

Yet Assemblymember Sandré Swanson (D–Oakland) brushed aside those arguments. "I’ve been involved in Bay Area politics for more than 30 years," he told us. "I’ve seen these same claims made against farmworkers as they were organizing for better conditions. I’ve seen these arguments made when we were raising the minimum wage. I think the opposite is true. If you have a workforce with a livable wage, it’s a more productive workforce, and I think everyone benefits. Truckers deserve more, and we’re going to do what we can to help them."

Oakland City Council president Ignacio de la Fuente, who drafted and helped pass a minimum-wage law for port employees, told us he supports the right of truckers to unionize but labor and environmental concerns must be balanced with economic growth. "You can’t ignore the fact that you have the port of Oakland competing with other ports," he said. "I support the fact that the Teamsters are going to bargain collectively on a national level. This port competes with other ports, and you cannot be put at a disadvantage."

Bloch says the coalition’s target is the shipping companies, not the trucking companies. "The shippers are hiding behind the trucking companies," he told us. "On the one side there are the giant shipping companies, like Wal-Mart and Target, huge global companies that demand low prices from trucking companies. On the other side are tiny trucking companies, immigrant truckers, and communities of color. Wal-Mart’s slogan is ‘always low prices,’ but ‘always low prices’ means one out of five children in West Oakland with asthma and drivers making $8 an hour who can’t support their families."

Oakland mayor Ron Dellums may be signaling his support for reform with two new appointees to the Port Commission. Even before he took office, Dellums was working to influence the Port Commission; as mayor-elect, he requested that outgoing mayor Jerry Brown hold off on appointing a new nominee so Dellums could appoint someone working on environmental and community impacts. He lost this battle when a majority of the city council voted to appoint Mark McClure, the director of marketing at a business technology company focused on security.

Dellums’s latest appointees, announced earlier this month, are a marked contrast to the business-oriented appointees of the Brown era: Victor Uno, a financial secretary with the International Brotherhood of Electrical Workers, and Gordon, the longtime resident and environmental activist in West Oakland.

"The port’s policy has been all about business and not about the people," Gordon told us. "The mayor really wants someone there to talk about health issues. I have never known a mayor to put someone on the commission and one of their engagements is to talk about health." She would also like to see a public participatory-process policy built into the port. "This is about sharing the power," Gordon said. "I don’t think West Oakland residents know they have power." She has "no problem" with truckers unionizing but also wants to find a way for drivers to remain independent contractors if they prefer.

Uno told the Guardian that he is highly supportive of the proposal. "I think that if the whole commission takes the lead of Mayor Dellums that this proposal will be very seriously considered," he said. "I’m very optimistic." Asked if he thought a proposal could succeed without requiring trucking companies to hire truckers as employees, he said, "I do not see how that is possible, given the lack of regulations in the trucking industry. It’s a dog-eat-dog world among independent truckers."

DEREGULATION HISTORY


The ports were not always structured as they are now. Before the 1980s the Interstate Commerce Commission regulated trucking, and most truckers at California ports were members of the Teamsters. They had health care, pensions, and workers’ compensation insurance and were paid a middle-class wage.

As part of a national push toward deregulation in the late 1970s, Congress, spurred by President Jimmy Carter, deregulated the trucking industry in 1980. In the following few years, a flood of new trucking companies entered the ports, with shippers choosing between a growing number of companies for each job. As small trucking companies undercut one another in bidding wars, the falling rates translated into declining driver pay, the bankruptcy of Teamster-organized companies, and increasing reliance on independent contractors whom companies could hire without spending money on payroll taxes, health care costs, or other benefits that unions might try to extract.

Trucking expert Michael Belzer, an economics professor at Wayne State University, has shown that long-haul truckers now earn less than half of prederegulation wages and work an average of more than 60 hours a week, while retailers like Wal-Mart have thrived. "The low rates paid to truckers in this global-trade game acts as a subsidy for increasing the amount of trade," Belzer told us. "Pollution and safety hazards are the negative externalities." If all ports on the West Coast required employee drivers, he said, "the market result would be that cost and safety would go up, and pollution would go down."

There have been a handful of Teamsters-related or trucker-led rallies and work stoppages at the Port of Oakland since deregulation, including a technically illegal strike in 2004 protesting the soaring price of diesel fuel, which virtually shut down the port for eight days. Many of the same complaints of today’s port truckers were aired at that time — long waits in lines, poor pay, long hours, and no benefits.

"This business is like the Mafia," Lorenzo Fernandez, 36, said, standing in front of two metal taco trucks glinting in the noon sun, along with about a half dozen other truckers on their lunch break. "They’re doing whatever they want with us, between the [truck companies] and the shippers. There is so much competition between the companies, and they know that we need the job. They know that our kids will go hungry."

Muhammad Khan, 33, said he’s sometimes forced to make up for long wait times by driving dangerously fast on the freeways. "We have our families. We have to take care of them. We all risk our lives because we have to. We don’t make enough money if we don’t make a load," Khan told us.

"We’re all immigrants here," Fernandez said. "We make it possible for the economy to grow up, but they’re stepping on our faces…. We have to work together. Otherwise we are going to be slaves for life."

A sign on a chain-link fence near the taco trucks reads, "Got an old truck? The Port of Oakland can help! Replace your old truck today!" Call the number at the bottom of the sign, and a recorded message issues an invitation to an informational barbecue that took place four months ago. The message explains that the port will provide qualifying owners with up to $40,000 to replace trucks dating from 1993 or before with a 1999-model truck. But Schaff told us, "Due to overwhelming demand, new applicants are currently not being accepted."

Money for the program came from a $9 million settlement of a lawsuit West Oakland residents filed against the Port of Oakland in 1998, alleging that their health was being harmed by port operations. The port says it will replace a total of 80 of the estimated 2,500 port trucks with those funds. When asked if the port had a responsibility to truckers, Schaff said it was "consistent with the port’s commitment to social responsibility…. We’ve done a lot, and we’re going to do more."

But the only specific programs the port could point to were the truck replacement program, a trucker access committee and working group started after the 2004 strike, and new GPS cell phone technology that is being touted as a solution for bottlenecks. Chuck Mack, the Teamsters’ Western Region vice president, isn’t impressed. "They’re a joke," he said of the programs. "Very few independent contractors have utilized them."

The recent purchase of the GPS system particularly irritates Mack. "Here is a quasi-governmental agency supplying services to the trucking companies," he told us. "It’s bizarre that we’re using taxpayer money for this. Any other industry would buy the devices themselves."

"We don’t disagree with using this money" for truck replacement, Mack said, "but what you’re doing is blowing $2 million in taxpayer money. Years down the road they’re going to need a new truck and another million in taxpayer money. For Wal-Mart and Target it’s great because they can have the taxpayer pick up the bill. Without changing the model, it’s just a short-term fix at the expense of the taxpayer."

EMPLOYEE BENEFITS


Beyond the environmental and economic benefits of making truckers employees of the companies, the change also might improve port security. The federal Transportation Worker Identification Credential program, expected to be implemented in the fall, will check the identities of the nation’s 750,000 port employees, 110,000 of whom work as truckers. Under the present system, there is no way to track the independent port truckers.

Employees are easier to track, and they are also better for port security in other ways. Among low-paid port truckers, turnover rate is extremely high, according to the ATA. "We all know that having a stable, well-trained, reliable workforce only leads to more security," Bloch said. "If they’re trained, they can be the eyes and ears of the port."

Well-paid truckers also would lead to safer ports. In a 2005 report, Belzer showed that "a substantial fraction" of independent operators actually loses money each year, resulting in "a high risk of unsafe operations among those earning the least money." The low compensation also "presents a national security risk," his report read, "since those who desperately work to break even might be at risk to engage in activities that put the nation at risk, whether intentionally or unintentionally, just trying to find a way from not going under."

Driving past another long line of trucks idling outside a gate after lunch break, Bloch pointed out one truck. A placard on the back of the rig read, "End sweatshops on wheels."

The current port system "just heaps abuse and abuse on these truck drivers and this community," Bloch told us. "The big businesses like Wal-Mart don’t pay the cost of polluting Oakland. It’s the truck drivers and the community that pay the cost. People pay with their lives."

"You can’t fix the environmental problems without fixing the problems of the driver," he said. "And now you have labor and the community coming together, and that’s powerful."*

Needed: a campaign against privatization

EDITORIAL Of all the cities in the United States, San Francisco ought to be most aware of the perils of privatization. Much of the city burned down in 1906 in part because the private Spring Valley Water Co. hadn’t kept up its lines and thus was unable to provide enough water for firefighting. A few years later, in one of the greatest privatization scandals in American history, Pacific Gas and Electric Co. stole what was supposed to be the city’s publicly owned electricity, costing the local coffers untold hundreds of millions over the past 80 years.

This is a city that votes 80 percent Democratic and has always opposed the Ronald Reagan–George H.W. Bush–George W. Bush agenda. A large part of the local economy depends on public employment (the city, the state, the federal government, and the University of California are by far the largest employers in town, dwarfing any of the biggest private-sector companies).

And yet Mayor Gavin Newsom, who likes to say he’s a progressive, is pushing an astonishing package of privatization measures that would shift public property, resources, and infrastructure into the hands of for-profit businesses. He’s talking about privatizing the golf courses, some city parks, and even Camp Mather. He’s promoting a tidal-energy deal that would give PG&E control of the power generated in a public waterway. He hasn’t lifted a finger to stop the ongoing PG&E–Raker Act scandal. And he’s determined to hand over a key part of the city’s future infrastructure to Google and EarthLink (see Editor’s Notes, p. 1).

This nonsense has to stop.

It’s hard to fight privatization battle by battle. Every single effort is a tough campaign in itself; the companies that want to make money off San Francisco’s public assets typically have plenty of cash to throw around. They’re slick and sophisticated, hire good lobbyists, and generally get excellent press from the local dailies. And it works: even board president Aaron Peskin, who generally knows better, is now talking about accepting the private wi-fi deal.

So what this city needs is a unified, organized campaign against privatization.

When Reagan arrived in the White House in 1981, the single biggest item on the agenda of his political backers was an attack on the public sector. The way the right-wingers saw it, government took money from the rich and gave it to the less well-off. Government regulated business activity, costing major corporations a lot of money. Government — "the beast," they called it — had to be beaten back, demonized, and starved.

So the Reaganites used their top-rate public relations machine to make the public sector appear riddled with waste and fraud. They cut taxes, ran up record (for the time) deficits, and forced Congress to eliminate a lot of social programs. More and more of what the government once did was turned over to the private sector — the way the radical right liked it.

That political agenda still rules Washington, D.C., where even a fair amount of the war in Iraq has been privatized, turned over to contractors who are making huge profits while Iraqi and American kids die.

The attack on government has worked so well that even a very modest plan by Bill Clinton to create a national health care system was killed by the insurance industry.

But privatization doesn’t work. Private-sector companies and even nonprofits don’t have to comply with open-records laws and can spend money (including taxpayers’) with only limited accountability. Most private companies are about making money first and serving the public second; that means when private operators take over public services, the prices go up, worker pay goes down (and unions are often booted out), and the quality of the delivery tanks. Look at the real estate development nightmare that has become the privatized Presidio. Look at the disgrace and disaster that the privatized Edison School brought to the San Francisco Unified School District. Look at the glitzy café and the pricey parking lot that have replaced good animal care at the privatized San Francisco Zoo. Look at what has happened around the world when Bechtel Corp. has taken over public water systems — rates have gone up so high that some people can’t afford this basic life necessity.

Look what’s happened to the American health system. Look what’s happened in Iraq.

Government isn’t perfect, and the public sector has lot of management, efficiency, and accountability issues. But at least the public has some hope of correcting those problems. San Francisco ought to be a place where a major movement to take back the public sector is born and thrives.

Almost everyone in town ought to have an interest. Labor, obviously, opposes privatization. So should neighborhood advocates (who care about public parks and open space), environmentalists (because the entire notion of environmentalism depends on a healthy public sector), progressive community groups, and politicians. Even more conservative groups like the cops and firefighters ought to see the need to prevent their jobs from being outsourced to a private vendor.

A campaign against privatization could link wi-fi, PG&E, tidal power, and the golf courses. The campaign could force anyone running for office to address a no-privatization pledge. It could appear any time one of these rotten schemes pops up in town — and send a message that San Francisco doesn’t accept the economic agenda of the radical right.

I don’t think anyone except Gavin Newsom’s inner circle and the folks who run Google and EarthLink really likes the mayor’s wi-fi contract, but it now appears at least possible that the Board of Supervisors will approve some version of it.

Board president Aaron Peskin wants the service improved a bit and is demanding some written guarantees that it will actually work the way it’s supposed to. Some opponents of the deal are arguing that it ought to be treated as a franchise, not a simple contract, and they want more legal hurdles. The serious techies say it’s the wrong technology anyway and will be outmoded and worthless in just a few years.

But there’s something bigger going on here.

A high-speed broadband system for San Francisco isn’t a hot dog stand and boat-rental shop in Golden Gate Park. It isn’t a restaurant lease on port property. It isn’t the naming rights for Candlestick Park or a permit to operate a taxicab or deliver cable TV.

Those are contracts and franchises. This is a piece of municipal infrastructure; it’s more like the roads that cars and Muni buses use to carry people around town or the pipes that bring water to our houses or the public schools that educate our kids or the emergency communications system that takes the call when we dial 911.

This is part of the city’s future, part of its economic development, part of how its citizens will participate in the political debate, part of how we will all learn and think and talk to each other. This is the new public square, the new commons.

Why in the world would we want to give it to a private company?

I don’t care if EarthLink and Google are offering 300 kilobauds per second of download time or 500 or 1,000. I don’t care if they promise to give free laptops to anyone who can stand on their head and shout "search engine." I don’t care if they promise to paint every light pole in the city green. They are private outfits set up to make a profit for investors. They have no business owning what will soon be the city’s primary communication system.

San Francisco has kept private operators from controlling its drinking water. This water is considered a basic part of life, and it’s available at low cost: San Franciscans pay less than one one-thousandth the price of bottled water for the stuff that comes out of the tap, and it’s almost certainly better. Same with roads and bridges, police and fire protection, and basic education (although that’s still a struggle).

I don’t get why broadband is any different.

I don’t think this would ever have been an issue 50 years ago. The generation that survived the Depression (with massive public-sector investment and ownership) and World War II (with huge excess-profits taxes on big corporations) and built things like the interstate highway system and the University of California didn’t see government as evil and inherently dysfunctional. The public paid to invest in public services.

It was Ronald Reagan and his ilk who took a generation disillusioned by Vietnam and Watergate and turned it against the public sector (see "Needed: A Campaign Against Privatization," page 5). Now we’ve even got a privatized war (and look how well that’s going).

The supervisors should get beyond the wi-fi deal’s little details and think about what it really means. This is San Francisco. We know better.<\!s>*

The catch

How shocking, shocking to learn that frozen seafood being imported from China is so likely to be tainted — with pathogens, antibiotics, and even (according to the fastidious New York Times) "filth" — that our very own Food and Drug Administration felt obliged to issue an alert about it at the end of last month. Globalization, we have long been assured — mainly by shills for transnational corporations — is a great blessing, a means of producing the most goods at the lowest cost per some sterile and one-dimensional rule of economic efficiency. It’s the gospel according to Wal-Mart, and it certainly does seem to be producing a great flood of goods, if not great goods. And it probably is a great blessing — for the shareholders and executives of transnational corporations.

But there is a central fallacy to the case for globalization, and it is this: that we can reap the benefits of a global economy while keeping its problems quarantined overseas. Let the Chinese use child labor and foul their environment! We are safe here, in our low-prices-always bubble. Except, as we learn from the parable of the dirty frozen fish, we’re not. In a shrinking world, benefits and burdens alike tend to be distributed worldwide, and there are reasons — many of them unsavory — that articles produced in poorer countries (for consumption in rich ones) tend to cost less. Lower prices aren’t magic, and the fact that we are encouraged not to notice the connection between low prices and the methods that yield them tells us that the connection is important. If we saw and understood the connection, we might well act differently. We might stop to consider that the true cost of some item isn’t necessarily reflected in its retail price — and that more expensive items are sometimes worth the money.

You don’t get something for nothing, and if that’s the offer, then it’s time to start poking around. There’s almost certainly a catch, and the catch is seldom in our interest.

In my recent piece about Emily Luchetti and Stars (Without Reservations, 6/20/07), I slightly misconstrued the restaurant’s life span. In fact, Stars did survive for a few years into the new millennium — but under new ownership. Founder Jeremiah Tower sold out well before the year 2000.

No scrubs

Michael Moore is a divisive character, but he’s not the most controversial man in the United States. The first image in Sicko, the director’s first doc since 2004’s Fahrenheit 9/11, is of George W. Bush. But the liar in chief is only one of Moore’s targets this time around. In Sicko he goes after America’s entire health care system, examining how even folks who have health insurance are routinely screwed over by corporations that care more about profits than lives. Of course, he does it in typical Moore fashion, with big gestures, occasionally overwrought voice-overs, and a snarky humor that balance out what’s otherwise a gloomy tale.

There’s so much dejection here — babies dying because hospitals won’t treat them, Ground Zero volunteers being denied care, the exposure of corrupt insurance-company tactics, and worse — that comic relief is essential, Moore explained during a recent whirlwind visit to San Francisco. He’d just come from Sacramento, where the film was screened for enthusiastic members of the California Nurses Association.

"I’ll bet you that there are as many laughs in this film as some of my other films, but it doesn’t feel that way because there are so many sad moments," he said. "But you need that. The humor helps lead you from the despair to the justifiable anger."

Gimmicks like a Star Wars crawl to illustrate the hundreds of diseases insurance companies won’t cover lighten Sicko‘s tone, as do scenes in which Moore puts on his gee-whiz persona and travels to other countries (Canada, England, France) where emergency treatment comes quick and free and prescription drugs practically grow on trees. In France, he discovers, the government supplies nannies to do chores for new mothers — although I’m too cynical to totally accept that perk as the truth, especially since the mother interviewed is white and middle-class. Or is it my disgust with America’s shortcomings that clouds my judgment?

Disgust is what Moore is after, because it’s the kind of strong emotion that might actually motivate action. "I have to hold out some kind of hope that [change] is possible," he said. "[In Sicko, an American woman living in France] says, ‘The reason things work here is because the government is afraid of the people. In America the people are afraid of the government.’ So I’m hoping that people will stop being so afraid and apathetic and get involved."

One of Sicko‘s unlikely targets is former universal-health-care advocate Hillary Clinton — now among Washington’s top recipients of health-care-industry donations. In the film, the senator (and aspiring prez) is praised, then slammed, for her stance on the issue.

"I’ve always liked her. I had a chapter in my first book called ‘My Forbidden Love for Hillary.’ I always thought that she got a raw deal on the health thing that she tried to do. I could see instantly, as soon as she was in the White House, men were very threatened by her. There were whole Web sites devoted to her — hateful, hateful stuff," Moore said. "I have kind of a broken heart because of her votes on the war. And it was really sad, the discovery that she [later became] the second-largest recipient of health-care-industry money."

Moore, who said he’d lost 30 pounds in the past three months ("One way to fight the man!"), has high hopes for Sicko‘s long-range impact. "The whole system needs to be upended. If the American people actually listen to what I’m saying here, that we need to start rethinking everything in terms of how we treat each other and how we structure our society, a whole lot of other things are gonna get fixed, and we’re gonna be a better people. And I think the rest of the world is gonna feel a hell of a lot safer with a change of attitude."

Of course, Sicko wouldn’t be a Michael Moore movie without at least one moment that stays true to his prankster instincts. His controversial visit to Cuba has been well-documented elsewhere, so I won’t go into the details here. But I will say he was pretty delighted to ask, "Have you ever seen anyone sail into Guantánamo Bay?"*

The future of paper

TECHSPLOITATION Twenty years from now, paper will no longer be a tool for mass communication. Instead it will be a substance akin to plastic, a mere fabricated building material with industrial and consumer applications. At least, those were the thoughts that ran through my mind when I received a strange news release last week from a Finnish company called VTT, which trumpeted a business model that included developing new products based on what it called "printing technology" and "paper products." VTT has developed a prototype for bioactive paper that responds to enzymes and biomolecules by changing color. One idea is to use it in food packaging or air filters to get an early warning about toxins.

Weird innovations are great, but the most interesting part of this news release was about markets: "The goal is … to create new business for the paper industry … to introduce new innovations and market initiatives between the traditional ICT [information communication technology] and paper industries by combining IT, electronics and printing technologies."

Let us parse the high-flown language of commerce. VTT is saying the paper industry needs new markets, and high-tech, bioactive paper will help create them. But why? Obviously, paper has its uses — there are newspapers, magazines, notepads, and books to be printed! Why worry about making the stuff bioactive when you can just sell it to Random House or Conde Nast? You already know the answer. Print communication is dying out, and with it goes the paper industry. Over the past few months, I’ve witnessed the two biggest daily papers in my area, the San Francisco Chronicle and the San Jose Mercury News, announce budget cuts that will slash their staffs by one-quarter. What does that mean for the paper industry? Fewer orders for newsprint.

When Karl Marx wrote that every great historical event occurs twice — "first time as tragedy, second time as farce" — I doubt he had print media in mind. And yet the upset of the paper industry feels to me like the joke that comes after the tragedy of print media’s fast decline. Don’t get me wrong: I’m not one of those people who think that barbarians are storming the gates because anyone can publish their ramblings on MySpace instead of having to get David Remnick’s permission to publish their ramblings in the New Yorker. Still, I cannot help but feel wrenchingly bad when I think about what it will be like in the Mercury newsroom after a quarter of the editorial staff has left the building.

I won’t miss the paper, but I will miss the journalists.

What’s tragic is that print journalism has not tried to diversify its market as methodically as the paper industry has. Right now, VTT is just one of many companies trying to figure out cool new ways to use paper. But who is trying to figure out cool new ways to employ smart, highly trained print journalists? Maybe Dan Gillmor and a few other people running small nonprofits. But mostly, print journalists are having to figure the future out on their own.

Some will do what I’ve done, gradually moving from print media to online. I’ve gone from a print zine to an online zine to a weekly newspaper to print magazines to running a blog. This column you’re reading is syndicated to both print newspapers and Web sites. Nobody gave me guidance. No slick marketing dude from Finland came in and said, "Hey, maybe you should diversify and start creating bioactive journalism." Instead, I fumbled along on my own, trying to find the most stable place where I could settle down and write for a living. Other journalists won’t be as lucky or as willing to change. They may stop writing; they may become shills for the companies they once investigated; they may feel bitter or liberated or panicked. None of them deserve it. Somebody should have helped them get ready for this transition five years ago.

I live in a world where corporations care more about the future of paper than the futures of people who have made their living turning paper into a massive network of vital, important communications. This is not how technological change should work. You cannot discard a person the way you discard a market niche. That’s because people revolt. Especially journalists. *

Green City: A wiser Earth movement

GREEN CITY Have you ever wondered how many environmental and social justice nonprofits are really out there?

Noted local environmentalist Paul Hawken estimates there are at least one million and as many as 10 million do-gooder alliances throughout the world, toiling away at their local niche problems or tackling the grander crises of the day, staffed by volunteers sacrificing time and desperately trying to raise enough money and political will to rebuild from the ruins.

And while environmentalists often are derided — and even criticize themselves and their allies — for being too fractured, lacking focus and an overarching leadership, Hawken thinks that’s actually a good thing.

Hawken is the founder of the gardening and tool company Smith and Hawken and author of several books, including The Ecology of Commerce and Natural Capitalism (the latter with energy efficiency guru Amory Lovins). He runs the Sausalito research group Natural Capital Institute, and that is where the research began for his new book, Blessed Unrest: How the Largest Movement Came into Being and Why No One Saw It Coming.

Hawken attempted to quantify the entire environmental and social justice movement. He quickly realized its ever-shifting nature would make that impossible, and instead he’s qualified the movement into 414 taxonomies, from prison reform to chemical pollution, from ecopsychology to worker health and safety.

Blessed Unrest is both a history of environmental and social justice activism and an account of its modern efforts. Hawken traces the roots of the movement back to a meeting of a dozen abolitionists in 1787, identifying them as the first group of people who fought to better the lives of others they didn’t know. He lays bare the chilling truth that business owners then made the same economic arguments in support of slavery that corporations now make to justify the continued extraction of natural resources at the cost of human and planetary health.

Hawken contends that the environmental and social justice communities, despite their different objectives, actually function with the same core values. He thinks this plethora of small groups is a good thing and likens the overall movement to an immune system for the earth. The immunology of the human body became an even apter metaphor when he learned that the ability to heal doesn’t follow any top-down management but instead depends on cellular growth and change.

Now, rather than trying to count all the organizations, he’s invited them to account for themselves through WiserEarth (www.wiserearth.org), a Wikipedia-like database in which groups can post information and outreach.

"WiserEarth is a tool," Hawken told the Guardian. The "Wiser" part of the name is actually an acronym for World Index of Social and Environmental Responsibility, and Hawken hopes activists use the site to pool scant resources and spread their rich loam of knowledge. It’s a place where philanthropists can find organizations of a similar ilk, and perhaps most important, the Web site reflects the real identity of a group that could never find a room big enough to host all its members.

"It brings more awareness of the scope and diversity of the movement," Hawken said. "You can see yourselves as part of a larger whole. That’s very assuring and helpful."

The Web site is only a couple of months old, but there are already 106,000 organizations listed, and it’s growing daily. At his public appearances, Hawken now stands in front of a large screen scrolling a list of all the names. "People cry when they see it," he said. "Repeatedly, everywhere I show it. And I don’t try to make it emotional. The reason, I think, is it’s a relief. The relief has to do with scale."

Fighting the good fight can feel like an exhausting, frustrating, and lonely battle, an overextended run of a play called David and Goliath that should have left the stage long ago. Hawken said he never imagines an audience for his books, and though this isn’t exactly a rallying cry, there is an affirmation coming across that flagging activists, freedom fighters, and friends of the earth need to hear: keep it up. A food bill for San Francisco

OPINION You may not have heard about it, but Congress is busy deciding the fate of America’s food supply: what’s grown, how it’s produced and by whom, and how that food will affect our health and the planet. The roughly $90 billion Farm Bill, covering everything from urban nutrition and food stamp programs to soil conservation and agribusiness subsidies, will dictate much about what we eat and at what price, both at the checkout line and in long-term societal costs.

Despite valiant progressive efforts that may bring some change, the big picture is not pretty: increasingly centralized power over food, abetted by lax antitrust policies and farm subsidies that provide the meat industry and food-processing corporations with cheap raw ingredients; huge subsidies for corn and soy, most of which ends up as auto fuel, livestock feed, and additives for junk food, fattening America’s waistlines; and, despite organic food’s popularity, a farming system still reliant on toxic pesticides (500,000 tons per year), which pollute our waterways and bloodstreams while gobbling up millions of gallons of fossil fuel.

Closer to home, residents in poor urban areas like Bayview–Hunters Point are utterly deprived of fresh, nutritious food. These so-called food deserts — whose only gastronomic oases are fast-food joints and liquor marts — feature entire zip codes devoid of fresh produce. Government studies show this de facto food segregation leads to serious nutritional deficits — such as soaring obesity and diabetes rates — among poor people.

What’s to be done? Congress needs to hear Americans — urban and rural alike — who are demanding serious change, and shift our tax dollars ($20 billion to $25 billion a year in farm subsidies) toward organic, locally oriented, nutritious food that sustains farming communities and consumer health.

Locally, with leadership from the supervisors, a progressive San Francisco food bill could be a model for making America’s food future truly healthful, socially just, and sustainable — and encourage other cities to buck the corporate food trend. Such a measure could include:

Organic and local-first food-purchasing policies requiring (or at least encouraging) all city agencies, local schools, and other public institutions, such as county jails and hospitals, to buy from local organic farms whenever possible.

Incentives — backed by education, expanding markets, and consumption of local organic foods — to encourage nonorganic Bay Area farmers to transition to sustainable agriculture, while subsidizing affordable prices for consumers.

Healthy-food-zone programs with targeted enterprise grants encouraging small businesses and farmers markets to expand access to healthy foods in poor neighborhoods identified as deserts.

A city-sponsored education campaign discouraging obesity-inducing fast food and promoting farmers markets and other healthful alternatives.

Zoning and other incentives for urban and suburban farming.

Ultimately, the city needs a food policy council — including farmers, public health experts, antihunger activists, environmentalists, and others — coordinating these efforts. The city needs a progressive food bill, merging the interests of urban consumers, Bay Area farmers, and environmental sustainability, for a policy-driven alternative to our destructive industrial food system. *

Wikipedia activism

TECHSPLOITATION When I edit Wikipedia, I am fighting for the future. There are certain things and people whose memories I want preserved for generations to come so that curious searchers a century from now will know the full story. Via Wikipedia, they will get more than stories of great politicians and giant corporations from glossy histories. I want this user-edited, online encyclopedia to tell tales of the brave and the marginal as well as the notorious and the powerful. That’s why I’ve become a Wikipedia activist.

For years I was a passive reader of Wikipedia, particularly entries on obscure technology and pop culture. I think of Wikipedia as the first place to go when I’m researching something off the beaten track, like early episodes of Doctor Who or technical specs for the outputs on DVR players.

Last week, however, I finally shed my Wikipedia passivity and started editing entries myself. I hit a personal tipping point.

I was writing a profile about a novelist for an online magazine and discovered that this author’s Wikipedia biography page had been summarily deleted the week before on the grounds that it wasn’t notable enough. I had previously visited his entry early in my research because it contained a fairly complete list of everything he’d written. To make matters worse, when I read the history of the deletion, it turned out to have been done by a guy who knew absolutely nothing about this novelist’s areas of expertise. The deleter was a big contributor to Wikipedia, it’s true — but only on the topic of religion, particularly Lutheranism. How could that background possibly grant him the authority to determine whether a postmodern novelist and video game designer was notable or not?

So I signed up for a Wikipedia account and re-created this novelist’s entry from the Google cache and sources I’d gathered while writing the profile. I also wrote an explanation to the deleter, requesting that he not do it again.

And then, while I was at it, I re-created another entry recently deleted for not being notable enough — that of Sonia Greene, a pulp fiction writer and publisher of the 1920s who was briefly married to H.P. Lovecraft. Of all the insulting things to have happen, her entry had been erased, and people searching for her were redirected to an entry on Lovecraft. How’s that for you, future scholars? Looking for information about a minor pulp fiction writer? Too bad she’s not notable — but we can redirect you to an entry on a guy she was married to for two years. (A guy, I might add, who pissed her off so much that she burned all his letters when they divorced.) Yuck.

My experiences have made me strongly question the idea of "notableness" on Wikipedia. I am genuinely offended by the notion that obscure authors, technologies, ideas, and events should be deleted from what’s supposed to be a vast compendium of knowledge. It’s not as if Wikipedia is running out of disk space and needs to delete stuff to keep going. And it’s not as if an entry on an obscure writer will somehow undermine somebody’s ability to search for less obscure ones.

Besides, who is to say what is notable or not? Lutheran ministers? Bisexual Marxists? Hopefully both. For me, the utopianism of Wikipedia comes from its status as a truly democratic people’s encyclopedia — nothing is too minor to be in it. Everything should be noteworthy, as long as it is true and primary sources are listed. If we take this position, we avoid the mistakes of 19th-century chroniclers, who kept little information about women and people of color in archives because of course those groups were hardly notable. Yet now historians and curious people bang their heads against walls because so much history was lost to those deletions.

If the goal is to preserve knowledge, we shouldn’t be wasting our time determining what’s notable enough to stay in Wikipedia. Instead, we should be preserving in a searchable form everything we can that’s truthful, so the culture and history of the minor and the obscure can be remembered just as easily as those of the famous and the mighty. *

Green libertarians

TECHSPLOITATION It sounds crazy, but it just might work: green libertarianism could become the new reformist movement in politics and cultural life.

In the 1980s, suggesting that green culture could be combined with libertarianism would have been worse than foolish. Those were the days when libertarians protested having to get their cars smog-checked because it represented government control of their personal property. But now that even staunch Republicans like Governor Arnold Schwarzenegger are promoting ecofriendly policies and business leaders like Silicon Valley venture capitalist Vinod Khosla are hanging out at the Sierra Club, it seems that the times, they are a-changin’.

Over the past decade, experts have slowly and quietly been publishing studies on how to bring green sensibilities into line with the free-market agenda of libertarians. Natural Capitalism, published in 2000, was one of the first books to advance this idea. Last year two Yale environmental researchers, Daniel Esty and Andrew Winston, published Green to Gold, which explores ways that companies like Wal-Mart are attempting to bring sustainability into their business models. Though Esty and Winston conclude that there are no companies currently doing enough to be truly green, they acknowledge that some are on the right track.

They also explain quite succinctly why free-market leaders have joined what they call the Green Wave. No, it’s not out of the goodness of their hearts. "Behind the Green Wave are two interlocking sources of pressure," they write. "First the limits of the natural world could constrain business operations, realign markets, and perhaps even threaten the planet’s well-being. Second, companies face a growing spectrum of stakeholders who are concerned about the environment."

A lot of Green Wave entrepreneurs are probably disingenuous. One imagines they’re like the antihero of underrated movie I Heart Huckabees, a slimy corporate type who feigns interest in green development to sucker a community into signing over its land to condo and mall developers. But I believe some real-life Green Wavers are genuinely fascinated by strange new ideas that could encourage economic growth and sustainable development. These are people who are talking about carbon credits, emissions trading, and various financial incentives for entrepreneurs who limit their environmental impact, recycle, use alternative energy sources, or encourage their employees to carpool.

The question is why would anybody want to marry green and libertarian values? It sounds like a way of letting business do an end run around international bodies and governments, groups that have traditionally set limits on industry. There’s no doubt that states should have a role in setting policies for local corporations, but those corporations need rewards for their good behavior too. That’s where capitalism comes in. Combining libertarianism with green values might be a pragmatic way to convince some of the worst polluters to cut back by essentially bribing them with cash. The state can step in to punish bad actors who refuse to try for the carrot.

On a less cynical note, one might say that libertarians and greens go together because both are focused on maintaining economic development in the long term. They aren’t looking at next quarter: they’re looking at next century. A green libertarian has realized that the freedom of future markets depends on maintaining a healthy environment.

If green libertarianism prevails, I’m guessing the future will look nothing like ecotopia and nothing like capitalist Utopia either. Business will behave more like government, limiting its growth for the sake of sustainability. And ecology as we know it will probably be a lot more engineered and synthetic than ever before because communities will carefully plan their ecosystems to remain healthy and whole alongside cities and corporations. We will reach a stage in our technological development when we have to manage our natural environments as well as our economic ones. Perhaps one day the capitalism that results from green libertarianism will know itself to be only one piece of a healthy social ecology. That’s the kind of capitalism that even a grumpy old Marxist like myself can get behind. *

Little green burners

GREEN CITY Today’s environmental problems — global warming, peak oil, drastically dwindling biodiversity, an unsustainable economic system that pollutes and consumes too much — are big. And there are many big solutions proposed by big governmental bodies, big individuals, and big corporations.

A major commitment is truly needed, but perhaps it’s the million small innovators and gestures that are most likely to add up to the most fundamental shift. Could these people, linked together, with enough freedom and support to pursue their visions, save the planet?

Burning Man founder Larry Harvey threw a stone into this pond last September when he chose Green Man as the theme for this year’s event, a decision that has rippled through the thousands of creative, capable people who spend much of the year tinkering in workshops around the Bay Area and across the country. People like Jim Mason.

Mason heeded Harvey’s call in his typically exuberant fashion, developing an innovative gasification system that turns biomass waste products into a usable fuel similar to natural gas. Collaborating with fellow artists and engineers in the Shipyard space that he created in Berkeley, Mason has been doing groundbreaking work.

The group converted a 1975 pickup truck owned by impresario Chicken John to run on substances like wood chips and coffee grounds, and Mason and John have been working principally with artists Michael Christian and Dann Davis to develop a fire-spewing, waste-eating, carbon-neutral slug called Mechabolic for Burning Man this year.

"Chicken’s shitty truck is going to be sitting in front of the Silicon Valley’s big alternative-energy conference for venture capitalists," Mason told the Guardian on May 22 as he headed to the Clean Technology 2007 confab, an illustration of the place little innovators are starting to find amid the big.

The New York Times featured Mechabolic in a technology article it ran earlier in May about the Green Man theme, and the project has been a centerpiece of the green evangelizing being done by Burning Man’s new environmental director, Tom Price.

Price has been working with hundreds of innovators like Mason to turn this year’s Burning Man, at least in part, into a green-technology exposition where creative types from around the world can exchange ideas. "It’s the Internet versus the big three networks" was how Price compared the big and small approaches to environmental solutions. "The goal is to show how easy and do-it-yourself profound solutions can be."

But ragtag approaches like Mason’s don’t fit well into institutional assumptions about art and technology, as he discovered May 11 when Berkeley city officials ordered him to shut down the Shipyard or bring it into immediate compliance with various municipal codes.

"They need to temporarily leave while they seek the permits that ensure it’s safe to be there," Berkeley planning director Dan Marks told us May 18. He criticized the Shipyard for using massive steel shipping containers as building material, doing electrical work without permits, and not being responsive to city requests.

The move stopped work on gasification and other projects as the Shipyard crew scrambled to satisfy bureaucratic demands — but it also prompted a letter-writing campaign and offers of outside help and collaboration that convinced Mayor Tom Bates and city council member Darryl Moore to meet with Mason on May 21 and agree to help the Shipyard stay in business.

Berkeley fire chief David Orth and other officials fighting the Shipyard say that Bates has asked for their cooperation. "A request has been made to see what can be done to keep the facility there but bring it into compliance," Orth told us.

All involved say the Shipyard has a long way to go before it’s legal and accepted by the city. Among other things, Mason must prove that the old, recycled oceangoing shipping containers (which enclose the Shipyard and other Bay Area artists’ collectives) are safe. But he and others are hopeful, driven, and convinced that they’re onto something big.

"Places like the Shipyard, which is a cauldron of ideas, don’t fit into the traditional model of how a city should work," Price told us. "The fringes, where the rules are a little fuzzy, is where surprisingly creative things happen." *

Out of downtown

It wasn’t going well for Ted Strawser, predictably. The alternative transportation activist faced an uphill battle March 14 trying to convince a San Francisco Chamber of Commerce committee to endorse Healthy Saturdays, a plan to ban cars from part of Golden Gate Park.

Representatives of the park’s museums and Richmond District homeowners had just argued their case against the measure. “Visitors want access to our front door, and we want to give it to them,” Pat Kilduff, communications director for the Fine Arts Museums of San Francisco, indignantly told the group of two dozen business leaders gathered around a large conference table.

Strawser gave it his best shot: he talked about following the lead of other great cities to create car-free spaces; he said, “Golden Gate Park is one of the best parks in the nation, if not the world”; and he made a detailed case for closure. But around the table there were scowls, eye rolls, and other obvious signs that Strawser was being tolerated, not welcomed. Some — including chamber vice president Jim Lazarus — even started to interrupt and argue with him.

Then the man sitting next to Strawser spoke up. “I don’t think this is fair,” he said. And suddenly, everyone in the room shaped up. Strawser’s ally — his only supporter in the room — was somebody no chamber member could or would dismiss. Warren Hellman doesn’t shout or bang the table — but when he speaks, downtown pays attention.

Hellman, a prominent investment banker, told the committee members that he expected them to show the same respect for Strawser that they had for the previous two speakers. The nonsense ended, immediately.

And by the time Strawser turned the floor over to Hellman, the mood had changed. The group listened raptly, smiled, and nodded as Hellman spoke in his usual folksy, familiar, disarming style.

“It’s not a lot of fun when friends fall out,” he began, “because the previous speakers and many of you all agreed on the necessity of the garage [that was built in Golden Gate Park], and we worked together.”

He pointed out that many in the group had promised during the fall 2000 election to support Healthy Saturdays once the garage was built, although Hellman was now the only member of the coalition honoring that commitment. But he didn’t chide or shame his colleagues. That isn’t Hellman’s style.

Instead, he spoke their language. The garage has never been full and needs the money it can charge for parking to repay the bonds. This isn’t a fight that’s going away, since “part of the conflict is because this park is everybody’s park.” But there are “about 100 compromises not acceptable to either side that would move this forward.” And if a solution can’t be found, there will probably be an expensive ballot fight that nobody wants.

“My conclusion is we should attempt this test,” Hellman told the group. Ultimately, when the vote was later taken in secret, the chamber didn’t agree, although it did vote to back a trial closure after the California Academy of Sciences reopens next year.

At the meeting, Hellman openly called for Mayor Gavin Newsom to get involved in seeking a compromise, something Hellman said he had also just requested of the mayor at a one-on-one breakfast meeting. A couple of weeks later Newsom — who had already indicated his intention of vetoing the measure — did broker a compromise that was then approved by the Board of Supervisors.

As usual, Hellman didn’t take credit, content to quietly play a role in making San Francisco a better place.

Healthy Saturdays isn’t the most important issue in local history — but the significance of Hellman’s involvement can’t be underestimated. His alliance with the environmentalists and park advocates might even signal a sea change in San Francisco politics.

Warren Hellman represents San Francisco’s political and economic past. And maybe — as his intriguing actions of recent years suggest — its future.

This guy is a rich (in all senses of the word) and compelling figure who stands alone in this town. And even though his leadership role in downtown political circles has often placed him at odds with the Guardian, Hellman consented to a series of in-depth interviews over the past six months.

“Our family has been here since early in the 19th century, so we had real roots here,” Hellman told us. His great-grandfather founded Wells Fargo and survived an assassination attempt on California Street by a man who yelled, “Mr. Hellman, you’ve ruined my life,” before shooting a pistol and barely missing.

The Hellman family has been solidly ruling class ever since, rich and Republican, producing a long line of investment bankers like Warren.

Yet the 72-year-old comes off as more iconoclast than patrician, at least partly because of the influence of his irreverent parents, particularly his mother, Ruth, who died in 1971 in a scuba-diving accident in Cozumel, Mexico, at the age of 59. “She was entirely nuts,” Hellman said, going on to describe her World War II stint as a military flier in the Women’s Auxiliary Service Pilots and other colorful pursuits. “She just loved people, a little like I do. She collected people.”

Hellman grew up wealthy and cultured, but he also attended public schools, including Grant Grammar School and Lowell High School. In between, the young troublemaker did a stint at San Rafael Military Academy — “reform school for the rich,” as he called it — for stunts such as riding his horse to Sacramento on a whim.

After doing his undergraduate work at UC Berkeley, Hellman got his MBA from Harvard and went on to become, at the age of 26, the youngest partner ever at the prestigious Manhattan investment firm Lehman Bros. He developed into an übercapitalist in his own right and eventually returned home from New York and founded Hellman and Friedman LLC in San Francisco in 1984, establishing himself as the go-to financier for troubled corporations.

“He is really one of the pioneers of private equity,” said Mark Mosher, a longtime downtown political consultant and the executive director of Gov. Arnold Schwarzenegger’s California Commission on Jobs and Economic Growth, on which Hellman sits.

Hellman became what Business Week called “the Warren Buffett of the West Coast,” a man of extraordinary wealth and power. Among other accomplishments, Hellman took Levi Strauss private, recently made billions of dollars in profits selling DoubleClick to Google, and manages the assets of the California public employee retirement funds (CalPERS and CalSTRS), which are among the largest in the world.

Like many financial titans, Hellman has always been a generous philanthropist, giving to the arts, supporting schools in myriad ways, and funding the San Francisco Foundation and the San Francisco Free Clinic (which his children run). He vigorously competes in marathons and endurance equestrian events, often winning in his age bracket. And he has his humanizing passions, such as playing the five-string banjo and creating the popular Hardly Strictly Bluegrass festival.

But he’s also been a prime facilitator of downtown’s political power, which regularly flexes its muscle against progressive causes and still holds sway in the Mayor’s Office and other city hall power centers.

Hellman founded, funds, and is a board member of the Committee on Jobs, which is perhaps the city’s most influential downtown advocacy organization. Hellman and his friends Don Fisher, the founder of the Gap, and Sen. Dianne Feinstein also started SFSOS, which now wages the most vicious attacks on left-of-center candidates and causes.

When the de Young Museum and other cultural institutions were threatening to leave Golden Gate Park, Hellman almost single-handedly had an underground parking garage built for them, in the process destroying 100-year-old pedestrian tunnels and drawing scorn from the left. The Guardian called it “Hellman’s Hole.”

“We at the Bike Coalition very much started out on the opposite side of Warren Hellman,” San Francisco Bicycle Coalition executive director Leah Shahum told us. “We couldn’t have been more like oil and water on the garage issue.”

But over the past two years or so, Hellman’s profile has started to change. He went on to become an essential ally of the SFBC and other environmentalists and alternative transportation advocates who want to kick cars off JFK Drive in Golden Gate Park on weekends, crossing the downtown crowd in the process. He has shared his wealth with progressive groups such as Livable City, which often fights downtown, and has stuck up for edgy fun seekers over more conservative NIMBY types. He has also publicly repudiated the attacks of SFSOS and its spokesperson, Wade Randlett, and withdrawn his support from the group.

Hellman is still a Republican, but a thoughtful and liberal-minded one who opposed the Iraq War and wrote an article for Salon.com in February titled “If the United States Were a Company, Would George Bush Be Our CEO?” (His answer: hell no.) And to top it all off, Hellman sports a few tattoos and even attended 2006’s Burning Man Festival and plans to return this year.

Unguarded and reflective, Hellman’s comments to the Guardian foreshadow the possible future of capitalism and influence in San Francisco and point to potential political pathways that are just now beginning to emerge.

Our first conversation took place at the Guardian office two weeks before the November 2006 election, when it was starting to look like Nancy Pelosi had a good shot at becoming speaker of the House of Representatives.

“I think this election in two weeks is going to be really interesting,” Hellman told us.

This Republican was cheering for the Democrats to win. “They aren’t my kind of Republicans,” he said of the people in power. Hellman didn’t support the war or approve of how the Bush administration sold it, and he wanted Pelosi and the Democrats to hold someone accountable.

“What I’d like her to do is admit that we can’t get out [of Iraq immediately], but start to talk about what the fallout has been. Discuss the enormous cost in human life as well as money, and how it’s possible the war united the Middle East against us,” Hellman said.

The one thing he can’t abide is disingenuousness. Hellman speaks plainly and honestly, and he asked us to keep particularly caustic comments off the record only a few times during almost six hours’ worth of interviews. He was self-effacing about his political knowledge and seemed most interested in working through the problems of the day with people of goodwill.

Asked what he values most in the people he deals with, Hellman said, “It’s authenticity. Do they believe things because they believe in them, or do they believe in things because they’re cynical or they’re just trying to gain something?”

Locally, Hellman has reached out to people with varying worldviews and come to count many friends among those who regularly battle against downtown.

“I love to know people,” he said. “That’s probably the single thing that motivates me. When someone says to me, ‘How can you be friends with [then–head of SEIU Local 790] Josie Mooney?’ I say, ‘Look, I want to know Josie Mooney. And if she’s awful, then we won’t be friends.’ I’m just fascinated by getting to know people. And virtually always, they’re a little like Wagner operas: they’re better than they sound.”

Hellman was the chair of the Committee on Jobs when he got to know Mooney, who chaired the San Francisco Labor Council and was a natural political adversary for the pro-business group, particularly when Hellman was leading the fight to do away with the city’s gross receipts tax, which has proved to be costly for the city and a boon for downtown.

But after that victory, Hellman turned around and cochaired a campaign with Mooney to retool and reinstate the gross receipts tax in a way that he believed was more fair and helped restore the lost revenue to the city.

“We lost, but he put $100,000 of his own money into that campaign,” Mooney told us, noting that the proposed tax would have cost Hellman and Friedman around $70,000 a year. “I think he just thought the city needed the money. It was a substantive point of view, not a political point of view.”

Mooney considers Hellman both a friend and “an extraordinary human being…. He has made a huge contribution to San Franciscans that doesn’t relate to ideological issues. A tremendous thing about Warren is he’s not ideological, even in his political point of view…. On politics, I’d say he is becoming more progressive as he understands the issues that confront ordinary people.”

Mooney is one of the people who have helped bring him that awareness. When they first met, Mooney said, Hellman told her, “You’re the first union boss I ever met.” That might have been an epithet coming from some CEOs, but Hellman had a genuine interest in understanding her perspective and working with her.

“In a sense, I think that was a very good era in terms of cooperation between the Committee on Jobs and other elements of the city,” Hellman said. “Josie and I had already met, and we’d established this kind of logic where 80 percent of what we both want for the city we agree on, and 20 percent [of the time, we agree to disagree].”

Committee on Jobs executive director Nathan Nayman — who called Hellman “one of my favorite people in the world” — told us that Hellman feels more free than many executives to be his own person.

“He’s not with a publicly held company, and he doesn’t have to answer to shareholders,” Nayman said. “He takes a position and lives by his word. You don’t see many people like him in his income bracket.”

Hellman has become a trusted hub for San Franciscans of all political persuasions, Nayman said, “because he’s very genuine. He’s fully transparent in a city that likes to praise itself for transparency. What you see is what you get.”

Hellman expects the same from others, which is why he walked away from SFSOS (and convinced Feinstein to bolt as well) in disgust over Randlett’s scorched-earth style. Among other efforts, SFSOS was responsible for below-the-belt attacks on Sups. Chris Daly, Jake McGoldrick, and Gerardo Sandoval (whom a mailer inaccurately accused of anti-Semitism).

“If all things were equal, I’d just as soon that SFSOS went away,” Hellman said. “SFSOS started doing the opposite of what I thought they would be doing, so it was fairly easy for me to part company with them. What I thought we were doing is trying to figure out ways to make the city better, not just being an antagonistic, nay-saying attack organization. I’m not a huge fan of Gerardo Sandoval, but I thought the attacks on him were beyond anything I could imagine ever being in favor of myself. And it was a series of things like that, and I said I don’t want anything more to do with this.”

Downtown, they’re not always quite sure what to make of Hellman.

“Every once in a while, he does things that irritate people who are ideologically conservative,” Mosher said. “He took an immense amount of heat for supporting the Reiner initiative [which would have taxed the rich to fund universal preschool].”

He’s given countless hours and untold riches to public schools, doing everything from endowing programs to knocking on doors in support of bond measures and often pushing his colleagues to do the same.

“My connection to him has been through the school district, and he’s really been a prince,” Sup. Tom Ammiano said. “He has even stopped calling me antibusiness. He put a lot of his energy into improving public education, and so he shows it can be done.”

Progressives don’t always agree with Hellman, but they feel like they can trust him and even sometimes win him over. “If you get a relationship with him and you’re always honest about the facts and your own interests, he will listen, and that’s pretty remarkable,” Mooney said. “He shows a remarkable openness to people who have good ideas.”

His appreciation for people of all stripes often causes him to reject the conventional wisdom of his downtown allies, who viciously attacked the Green Party members of the Board of Education a few years ago.

“Everybody said, ‘Oh my god, Sarah Lipson, you know, she’s a Green Party member, she’s the furthest left-wing person on the board,’ blah, blah, blah,” he said. “And I phoned her up one day and said, ‘I’d really like to meet you.’ And she’s — leave aside the fact that I think she’s a very good person as a human being, but she’s a very thoughtful, analytic person. Listening to her opinions about things that are happening in the school district, I really respect that. I mean, what do I know about what’s going on in the school district? I know more now than I did then. But just getting to know people, and maybe get them to understand my point of view, which isn’t that penetrating.”

Many of his efforts have received little publicity, as when he saved the Great American Music Hall from closure by investing with Slim’s owner Boz Scaggs and helping him buy the troubled musical venue. “There are things that you and I don’t even have a clue that he has done,” Nayman said.

“He’s an interesting guy,” Mosher said. “He’s one of a dying breed, a liberal Republican. He has a social conscience and wants to use his money to do good.”

Actually, calling Hellman liberal might be going too far. In the end, he’s still very much a fiscal conservative. He doesn’t support rent control, district elections for the Board of Supervisors, taxing businesses to address social problems such as the lack of affordable health care, or limits on condo conversions.

He also opposes the requirement that employers provide health care coverage, which downtown entities are now suing the city to overturn, telling us, “In general, I don’t think it’s a good idea, because I’m still, even in my aging years, a believer that the marketplace works better than other things…. Universal health care I do believe in, but what I worry is that it’s going to be another damned bureaucracy and that it’s not going to work.”

Yet he doesn’t believe wealth is an indicator of worth, saying of his fortune, “It is luck. Most of what you do you aren’t better at than everyone.”

He doesn’t believe in the law of the jungle, in which the poor and weak must be sacrificed in the name of progress. In fact, he feels a strong obligation to the masses.

As he told us, “My mantra for capitalism — and I didn’t invent this, but I think it’s pretty good — is that capitalism won, and now we need to save the world from capitalism.”

Hellman looms large over downtown San Francisco. His Financial District office offers a panoramic view of the Bay Bridge, Treasure Island, the Ferry Building, and the rest of the city’s waterfront. He likes to be personally involved with his city and the companies in which Hellman and Friedman invests.

“Usually I’m directly involved,” he told us in an interview earlier this year. “I’ve always said that I don’t like to go to the racetrack to just look at the horses. The fun of being a principal is that you’re standing at the track and not saying, ‘Gee, that’s a beautiful gray horse.’ You’re saying, ‘Come on, he’s got to win!’ So I’m almost always invariably invested in the companies that we work with, either individually or through the firm.”

Unlike many Wall Street barons who strive to control a company and bring in new executives, flip it for a quick profit, or liquidate it, Hellman said his firm tries to identify solid companies and help facilitate what they do. “We don’t usually take over companies. I always think that we provide a service to help the businesses,” he said. “Our job is kind of the opposite of owning a factory. Our job is to be sure the people who run the business feel like it’s their business.”

Similarly, he thinks capitalists need to feel a sense of ownership over society’s problems, something he thinks is taking root in San Francisco and other economic centers, particularly among the younger generations. “It’s about understanding how much suffering there is on the other side and trying to figure out how that suffering can be alleviated,” he said. “I think it’s partly good economics that as you bring people up, they’re able to do more for society. If nothing else, they’re able to buy more and shop at a Wal-Mart or something — probably someplace you would wildly disapprove of — and buy goods and services. But I don’t think it’s that narrow.”

Rather, he believes that everyone has a little progressive in them, a little desire to cooperatively solve our collective problems rather than pass them off to future generations. He sees a marked change from his days at Lehman Bros.

“Everybody was into making it,” he said, noting that many capitalists then did charity work as a means of attaining social status but focused mostly on the accumulation of wealth. But, he said, the new generation of capitalists seems genuinely interested in improving the world.

“The feeling for giving back in the next generation, in the now 25- to 35-year-olds, it’s just an order-of-magnitude difference than it was for people who are now in their 40s and early 50s,” Hellman said. “I’m very encouraged.”

Yet the flip side is that, in Hellman’s view, downtown doesn’t wield as much power as it once did. Low political contribution limits have made politicians less dependent on downtown money, creating fewer shot callers, while democratizing tools such as the Internet have broadened the political dialogue.

“For the last 30 years we have become an increasingly tolerant city, and that’s great,” he said. “In the old days, [the Guardian] complained about downtown, and yeah, no shit, downtown really did control the city. The benefit was as that slipped away, the city became fairer and more open to argument. So now downtown hardly has any power at all anymore. In a sense, that’s a good thing. Tolerance grew tremendously when the city wasn’t dictated to.”

That tolerance caused street fairs to pop up all over town and festivals such as Hellman’s Hardly Strictly Bluegrass to blossom in Golden Gate Park. Bike lanes have taken space from cars, events such as Halloween in the Castro have gotten crazier, street protests have gotten bigger and more frequent, and people have felt more free to fly their freak flags. And all that freedom eventually triggered a backlash from groups of isolated NIMBYs who complain and often find sympathetic ears at city hall.

“Sometimes you get the feeling in this city that in the land of the tolerant, the intolerant are king,” said Hellman, whose festival has endured noise complaints even though the music is shut off by 7 p.m. “There is a continuing pressure to do away with fun, because fun is objectionable to someone, [but] we need to think about not creating a new dictatorship of a tiny group of people whose views are not in line with the opinion of most of the people of San Francisco…. You should try to balance the good of a lot of people versus the temporary annoyance of a few people.”

Preserving fun and a lively urban culture is a personal issue for Hellman, who plays the five-string banjo and calls his festival “the most enjoyable two days of the year for me.” He helps draw the biggest names in bluegrass music and acts like a kid in a candy shop during the event.

“I feel very strongly that an important part of our culture is built on the type of music and type of performance that goes on at Hardly Strictly Bluegrass,” Hellman said. From parables set to music to songs of struggle and the old union standards, “that kind of music is the conscience of our country.”

He considers bluegrass a vital and historically important form of political communication, more so than many of the upscale art forms that the rich tend to sponsor. “I’m glad that we have first-rate opera, but it’s equally important that we foster the kind of music, lyrics, etc., that support all this,” he said. “Somebody once said that most of the great Western philosophy is buried in the words of country songs. And that’s closer to the truth than most people think. A big passion of mine is to try to help — and people have defined it too narrowly — the kinds of music that I think have a hell of a lot to do with the good parts of our society.”

Perhaps surprisingly for a Republican venture capitalist from the older generation, Hellman also considers the countercultural freaks of San Francisco to be some of the “good parts of our society.” That’s why he attended Burning Man for the first time last year and why, he said, he loved it, as much for the culture and community as for the art.

“I went to Burning Man because as much as possible I want to experience everything,” he said. “I want to just see directly what it’s like. I knew I’d enjoy it. I never doubted that. But what really overwhelmed me is it was 40,000 people getting along with each other. I mean, it’s pretty intense. There were dust storms and the world’s most repulsive sight: nude men over 70 just dangling along. But I never saw an argument. It was 40,000 people just enjoying each other.”

It was most striking to Hellman because of the contrast with the rest of society. As he said, “I’ve never seen this country so divided.”

While Hellman supports Schwarzenegger — calling him “a good advertisement to California” — he has nothing good to say about his fellow Republican in the Oval Office. He calls Bush’s tenure “an absolute four-star disaster.” The invasion of Iraq is the most obvious problem, he said. “Our war policy has slowly veered from being ‘Don’t tread on me’ to we’re going to jump on your neck.”

But his antipathy to certain aspects of the Republican Party began even earlier, when the religious right began to take over.

“I thought we were not that polarized during the Clinton administration. I was somewhat encouraged,” Hellman said. “Maybe there was an undercurrent of strident religious behavior or strident conservatism, but not the conservatism that I think the Republican Party used to stand for, which was fiscal conservatism instead of social conservatism. Somehow, there was this angst in this country on the part of religious people who I guess felt this country was being taken away from them, and they were the kind of stalwart or underpinnings of society. And they took it back.”

But in the wake of that disaster, Hellman thinks, there is an opportunity for reasonable people of goodwill to set the future political course. As Nayman said of Hellman, “He does believe there is a middle way pretty much all the time.”

Politically, that’s why Hellman gravitates toward the moderates of both major parties, such as Schwarzenegger and Newsom. He looks for people who will marry his economic conservatism with a regard for things such as environmentalism and social justice.

“It’s very tough to be a big-city mayor,” Hellman said. “[Newsom is] probably the best mayor we’re entitled to. He’s got this fantastic balancing act.”

Hellman said downtown hasn’t been terribly happy with Newsom for supporting striking hotel workers, getting behind Ammiano’s health insurance mandate, supporting tax measures, and generally letting the Board of Supervisors set the city’s agenda for the past two years.

“Their measure is he has 80-percent-plus popularity, and he ought to spend some of it. Well, they might not agree with what he would spend it on. And he’s been unwilling to spend very much of it. In some parts of the business community there is disappointment with him, but I don’t think that’s right. He didn’t hide what he would be like.”

What Newsom said he would be — a big reason for his popularity — is a mayor for the new San Francisco, a place where the city’s traditional economic conservatism has been tempered by a greater democratization of power and an ascendant progressive movement that expects its issues to be addressed.

“I don’t like people who are intolerant,” Hellman said. “I don’t like people that are telling you something to get some outcome that, if you understood it, you probably wouldn’t want. I like people that are passionate.”

Asked, then, about Sup. Chris Daly, the nemesis of downtown and most definitely a man of strong political passions, he said, “I admire Chris Daly. I disagree with Chris on a lot of things he believes, but there are also probably a lot of things I would agree with Chris on. And I respect him.”

Hellman is the rare downtown power broker who wants to bridge the gap between Newsom — whom he calls a “moderate to conservative establishment person” — and progressives such as Daly, Mooney, and the Bicycle Coalition. The middle ground, he said, is often a very attractive place, as it was with Healthy Saturdays.

“I’m sure you spend time in the park on Sunday, and it’s a hell of a lot nicer in there on Sundays than Saturdays,” Hellman said. But even more important to him, this is about integrity and being true to what Golden Gate Park garage supporters promised back in 2000.

“They were proposing Saturday closing at that time, which I’ve always thought was a good idea,” he said. “And we made a commitment to them, or I thought we made a commitment to them, that let’s not have Saturday closure now, but as soon as the garage was done, we’d experiment with Saturday closure.”

We brought up what Fine Arts Museums board president Dede Wilsey has said of that pledge, that it was under different circumstances and that she never actually promised to support Saturday closure after the garage was completed.

“There’s a letter. She put it in writing,” he said of Wilsey. “She signed a letter on behalf of the museums saying that when the de Young is done, we should experiment with Saturday closings.”

The Bike Coalition’s Shahum said that even when Hellman was an enemy, he was a reasonable guy. But it’s in the past couple of years that she’s really come to appreciate the unique role he plays in San Francisco.

“He showed decency and respect toward us,” she said. “We never saw him as a villain, even though we disagreed completely. Later he really stepped up and has been a leader on Healthy Saturdays. And what I was most impressed with is that he was true to his word.”

Supervisor McGoldrick, who sponsored the measure, echoed the sentiment: “Hellman was certainly a man of his word who acted in a highly principled way.”

So why does Hellman now stand apart from the downtown crowd? Has he parted ways with the economic and cultural power brokers who were once his allies?

No, he said, “I think they parted ways with me.” *

Four years ago we shut down the city. None of us who were there will ever forget it: so many peaceful protesters showed up that the police had to close down Market Street. Mission Street was pretty much the same way. You couldn’t get anywhere downtown; nobody seemed to be at work. The police were, in more than a few instances, out of control — but there were no water cannons or rubber bullets, just a lot of arrests. Overall, it was a day of joy: the United States was going to war, and San Francisco would have no part of it.

The anniversary protests, while exuberant, weren’t quite that dramatic. I understand: it’s been a long, long war, and we’ve all be fighting for a long, long time, and things just seem to be getting worse. The antiwar movement, and the frustration of the nation at a conflict that has dragged on longer than US involvement in World War II, tossed the Republican majority out of both houses of Congress, but the Democrats are still talking about nonbinding resolutions and incremental plans that can’t be backed up. The war seems to be without end. Even the New York Times, that voice of mainstream moderation, is starting to sound pissed off: the March 18 lead editorial referred to "the unnecessary, horribly botched and now unwinnable war."

I know this doesn’t help the families of the more than 3,000 already dead soldiers or the tens of thousands more who are still stuck in a desert quagmire, but the good news is we’ve won the debate. Almost nobody running for president wants to say the war was a good idea, has been handled well, or ought to continue much longer. The only question on the table now is how best to get the hell out. And in the long term, this really has become the new Vietnam — just as the very name of that southeast Asian country struck fear in the hearts of American imperialists and military adventurists for a quarter century, the legacy of Iraq will almost certainly be stricter controls on the ability of rogue presidents to invade countries for their own geopolitical agendas.

So let’s keep the pressure on the likes of Nancy Pelosi (it’s so heartwarming to see protesters camped outside the house of the new House speaker — and it’s stunning that Pelosi has been such a jerk and refused to be civil to them). And take heart: we can still end this war — and go a long way toward preventing the next one.

And on a totally different note: I was somewhat amazed to see that the Hearst Corp. and MediaNews Group — the companies that own all the major newspapers in the central Bay Area — have come up with a new tactic to get rid of that pesky antitrust suit filed by Clint Reilly.

The suit charges that the deal giving two giant corporations control of so much of the region’s media will deprive readers of diverse viewpoints and advertisers of competitive alternatives. The evidence in favor of Reilly’s claim is pretty strong.

So now the newspaper barons are taking a new tack, arguing that Reilly has no standing to sue. He’s just one person; what’s the harm to him?

Well, gee, if one person who cares about the community has no standing to sue, who does? Hearst and MediaNews, I suspect, would like to leave that to the state and federal attorneys general. And look how that’s worked out. *

Newsom’s latest hypocrisy

Gavin Newsom has a slick new website, which his campaign team has decided to call actlocallysf.org, I guess to give the impression that it’s more than flackery for the mayor. The lead item on it is, in fact, a nice piece by the head of the Business Alliance for Living Local Economies, talking about how to create an economically sustainable city.

But that’s actually a serious policy challenge that involves taking on big, powerful international interests — and Newsom isn’t doing any of that. In fact, if you scroll down the page, you find an article on why San Francisco should turn over the future of its electronic communications infrastructure to a couple of giant corporations.

A real sustainable city would look at creating the network locally, using city funds and local nonprofits and small businesses, and keeping control of it in the public sector. Gavin: get with the program.
