GOOD Magazine put together a very handy guide to the big bad corporations that have co-opted the natural food companies you know and love. It’s sad, folks. Some, like the Odwalla-Coca Cola connection aren’t breaking news, but man, I didn’t know Dagoba was in bed with Hershey.

Green dreams

As we celebrate Earth Day in this era of all things green, it’s worth contemplating whether our enviro-guilt has gotten the better of our skepticism and critical thinking. Is “Green=Good” our sole metric these days, making us susceptible to self-serving spin from our politicians and corporations? After all, our Governator seems to have gone from bad to good simply by donning verdant armor and signing a landmark global warming measure that he long fought and watered down.
Closer to home, PG&E’s has been trying to greenwash away our knowledge of their penchant for polluting technologies and political corruption, a quest that our lazy but ambitious and ever image conscious Mayor Gavin Newsom has sporadically tried to piggyback on (ie tidal power, sponsored conferences, and solar everything). When Newsom tried to beef up the city solar commitment by robbing a seismic upgrade fund for renters and then the city’s own bank for building municipal solar panels, it was understandable that the Board of Supervisors balked.
But in today’s Chron, SPUR policy wonk Egon Terplan and righteous activist Van Jones whack the move and decry city plans for more fossil fuel generation. It’s not a bad point, although it is an oversimplistic one, like too many of our either-or green political debates these days. Indeed, we seem to lose the ability to see shades of gray when we talk green, and we too often forget that money is the other form of green in the equation.
As we’ve reported, San Francisco’s solar problems are complicated, just like our power generation problems (see our story in tomorrow’s paper for a more nuanced look at the peaker plant issue). To solve the problems, we need honest leaders speaking candidly to us and each other, rather than all the spin, self-interest, and political gamesmanship that has sullied San Francisco’s political dialogue in recent years.
Green can be good, or it can be the equivalent of snake oil or the IPO for a overhyped tech company that will never make any money. As an excellent recent cover story in Harper’s Magazine noted, the green economy could be the next great bubble after the housing and dot-com crashes, something that desperate capitalists and their political partners are eagerly trying to make so.
Maybe that will be a good thing, but let’s learn our lessons from the last couple bubbles and don’t simply assume that the green label is some kind of stamp of public interest approval.

Feminist art has reemerged in the past few years as the focus of major exhibitions including "WACK! Art and the Feminist Revolution" at the Museum of Contemporary Art, Los Angeles, and "Global Feminisms" at the Brooklyn Museum, which coincided with the unveiling of the museum’s permanent home for Judy Chicago’s iconic The Dinner Party (1974–79). On one hand, it’s inspiring to see such work resurface, especially at this political moment, when it becomes increasingly important to recall dissident factions in our country’s history. On the other hand, exhibitions such as "WACK!" can feel like regurgitations of the same old feminist art show with the same discourse, participants, and audience. It’s not enough to dust off these works and lump them under the vague and often misunderstood descriptor "feminist." To engage today’s audiences, it’s necessary to pull apart the threads, identifying what was and is at stake for these artists.

"The Way That We Rhyme: Women, Art & Politics," curated by Berin Golonu and on view at Yerba Buena Center for the Arts, unites a new generation of women artists who honor their feminist predecessors while embracing new and more sly and subversive tactics. I increasingly hear women of my generation and younger vehemently disavow feminism, despite the current curatorial interest, as if there’s a stigma attached to the word. But "Way" takes feminist art out of the past and into the present.

In The Counterfeit Crochet Project (Critique of a Political Economy), Stephanie Syjuco takes aim at the luxury goods industry: the beautiful and coveted couture accoutrements that promise to make women equally beautiful and coveted, for a price. Seeking to reconcile the desire to possess such items with not wanting to invest in multinational corporations or sweatshops, Syjuco posted instructions on her Web site on how to crochet one’s own Fendi or Prada bag. Many women heeded the instructions, and their finished products are on display. The project also alludes to crochet as a traditionally devalued variety of "women’s craft." Similar knitted works appear throughout "Way," such as Lisa Anne Auerbach’s 2007 wool sweater and skirt sets, inscribed with political slogans.

Aleksandra Mir captures an unprecedented landmark in First Woman on the Moon, a 1999 video work that might be described as a "small step for a woman, a giant leap for the history of womankind." Playing off some people’s belief that Neil Armstrong’s moon landing was a hoax, Mir creates her own version of the event, wielding her camera — the instrument of news media — to insert women into history. After all, if Armstrong’s landing was — at the very least — plausible, then so is this landing. Filmed on a Dutch beach, Mir doesn’t try too hard to make the setting look authentic; in her version, the moon landing is less a colonization of outer space and more a celebration of life on Earth.

In a more somber piece, Portrait of Silvia-Elena, street artist SWOON and documentarian Tennessee Jane Watson collaborate to bring visibility to the horrifically high numbers of young women disappearing and turning up dead in Juárez, Mexico, and throughout the Americas. Some 400 women’s bodies have been recovered in Juarez, and an additional 1,000 are still recorded missing; in Guatemala, 2,000 women have been murdered. At the entrance to the installation — made to look like a dilapidated brick wall — is SWOON’s beautiful, angelic relief-print portrait of a 15-year-old victim in her quinceañera dress. The installation is also made up of photos of missing girls, as they are found plastered in Juarez, and an audiotrack of Watson’s interviews with the mothers of the disappeared.

One of the more challenging works is Beg for Your Life (2006) by Laurel Nakadate. A video artist accustomed to being looked at by men, Nakadate collapses her experience as subject and object, placing herself in front of her own camera to enact scenes with various older men — all strangers whose gaze she met on the street. In one scene, Nakadate’s back is to the camera as she seductively poses for her admirer. The man thinks he is in the subject seat, dictating his fantasies to the object of his desire, but really the camera is on him. Nakadate scores the video with 1980s pop songs, yet the content is not always amusing: some of the men’s fantasies are violent, and you wonder if the artist didn’t put herself at real risk.

The interplay between female and male subjects and objects in Nakadate’s work brings to mind one thing I might add to "Way": male artists. While I understand the rationale for creating a dedicated space for women’s art, I think in some ways it only further marginalizes women. Let’s integrate women’s political art into the larger context and invite men to participate, reminding them that feminism is — and has always been — about men too.

Chain, chain, chain…

According to intern Ailene Sankur, sometimes a girl just needs a subpar, average meal at a crappy chain restaurant.

I have a confession to make: sometimes, I need to go to a chain restaurant. I know, I know, I live in a gourmand’s paradise. And yes, I love to support family-owned small Indian, Turkish, and Mexican joints. I hate corporations, hate cheesiness, hate tchotchkes and flair. But sometimes, I just need to go into my happy suburban place. The place that takes me back to the Target, Ross, and TJ Maxx stores of my youth, with their big, wide, unmonitored parking lots where I could probably leave my car for weeks unnoticed.
Yes, the food is subpar, but it’s consistent in its average-ness. And sometimes, you want to step away from all the culinary razzle-dazzle and just eat something blah in a place where the “kooky, original” décor is the same as it is in your fave chain back home for a Twilight-zone eerie, but strangely soothing effect. Talk about Walter Benjamin’s theories of “art in the age of mechanical production” in a ginormous booth—another wonderful thing about chains…no more tiny wood tables crammed next to a loud kitchen—decorated in southwestern tiles and a big sign that says “Chili cook-off.”

So, if you’re like me and sometimes you just want to eat an homage to your Stepford childhood, here’s a list of chain restaurants close to the city:

New Deal Feted

The New Deal turned 75 yesterday, March 31st. About 150 people turned out to the Koret Auditorium in the main SF library to mark the occasion and to listen to a six-person panel discuss the series of landmark government initiatives. Supervisors Chris Daly and Ross Mirkarimi, two authors and two union organizers called for a return to the core principles of social justice and fair treatment that led to such things as minimum wage laws and the formation of social security.

“They did it in the 30’s, we can do it now,” Harvey Smith, adviser to the Living New Deal Project, told the audience. Smith was upset over the potential privatization of the Cow Palace, and joked that the city may sell of chunks of Golden Gate Park soon.

Sup Daly’s main concern was affordable housing and making sure the city represents ordinary people instead of big downtown businesses. “We don’t have enough resources to fund what we need, like schools and hospitals because we give corporations too many tax loopholes,” Daly said.

The panel urged the audience to organize their communities in fighting the privatization of San Francisco, which they said would make this city a haven for the elite. “The New Deal wasn’t just a gift from Congress, workers had to fight for it. If change is going to happen, it will be from the bottom up,” labor activist Karega Hart said.

Freedom of Information: Battleship metadata

On Valentine’s Day, Assemblymember Jose Solorio (D-Santa Ana) introduced Assembly Bill 1978, legislation that seeks to define computer mapping systems and make them available to commercial interests at a fee — a one-two punch that freedom of information advocates fear constitutes a serious blow to the California Public Records Act.

Noting that computer mapping systems, computer programs, and computer graphic systems do not constitute public records under current law, Solorio’s bill seeks to amend the CPRA to define computer mapping systems to include "assembled model data, metadata, and listings of metadata, regardless of medium, and tools by which computer mapping systems are created, stored, and retrieved."

AB 1978 would also allow "commercial interests, who are most benefited by these systems, to obtain the portion of these systems developed by a public agency, at a fee designed to offset the agency’s cost of maintenance for the computer mapping systems."

But Oakland-based Bruce Joffe, who works as a geographic information consultant to cities, counties, and state agencies in California, warns that AB 1978 would allow public agencies to charge the public more for this data than the cost of duplication.

"It would severely weaken the CPRA and reduce the public’s access to government records," said Joffe, noting that as the law currently stands, CPRA requires state and local agencies to make their records available and, upon request, to provide copies on payment of any applicable fee.

Solorio aide Hazel Miranda told the Guardian that the intent of the bill is to protect software, not to restrict access to information.

"Our intent is to protect the software, not to restrict the information that is given out on it," Miranda said, noting that the bill’s sponsor is the government of Orange County. "The concern was that a lot of corporations were taking this information — and when the information is given out, you have to give out the software, too — and using it to their own benefit."

Joffe, who was the California First Amendment Coalition’s technical advisor when CFAC successfully sued Santa Clara County over access to the county’s tax maps, disagrees.

"When you give information out, you are not giving out software, you are giving out data in export format," said Joffe, who believes Solorio wants to change the law so that AB 1978’s sponsor, Orange County, which has sold its tax maps for $400,000 in the past, can continue to sell its data.

Holly Fraumeni, the AB 1978 lobbyist with the well-connected firm Putf8um Advisors, deferred questions to Bruce Matthias of Orange County’s legislative affairs, who told us, "The County of Orange has never disagreed on sharing public data. We are not trying to hide data down here. If you want it on a disk, we charge 25 cents. All we are doing is updating language in the bill. Our exclusive intent is to protect the software we’ve developed." Records show Orange County paid Putf8um Advisors $60,000 between October 1 and December 31, 2007.

CFAC executive director Peter Scheer believes AB 1978 is an attempt to take the information that CFAC has tried to make freely available and put it back under lock and key, so that it is proprietary information that can be sold.

Recalling how, years ago, the only way you could see a county’s tax maps was as an engineer’s rendering on paper, Scheer observed that when this data is computerized and made publicly available, "individuals and businesses can create all kinds of valuable tools or simply post the raw data on the Internet."

Blair Adams, chief consulting officer at San Francisco’s Department of Technology and Information Services, says the city’s GIS data has been publicly available for five years.

"We have no intent to change that," Adams said. "Our motto is ‘Go have it, and help us make it better.’<0x2009>"

But while San Francisco treats this data as a public record and copies it for the price of a blank DVD, Santa Clara and Orange counties have treated it as a revenue generator.

"They charge an arm and a leg, and another arm and leg, and whatever other appendages they can think of," said Scheer, noting that Santa Clara County charges $100,000 for a full base map of its real estate parcels — data that can be used to determine whether properties are assessed correctly, and whether pothole repairs are carried out equitably.

"Likely clients willing to purchase this data would be utilities, phone companies, and developers, who can’t do without it," Scheer said. "But public health and safety departments need access to it, too."

Joffe agrees, and it’s something he has plenty of experience with. He helps cities and counties create geographic information systems that allow ambulances to take the most efficient routes, the Department of Public Works to carry out better capital improvements, and the police to conduct better crime analysis.

"Every department uses it, and because it’s in the government system, therefore it is a public record, and the public has the right to access those records at no more cost than it takes to duplicate them," Joffe said. He added, "If AB 1978 passes, we’ll lose considerable access."

Brad Will and the politics of oil

MEXICO CITY – Flash back to October 27th, 2006. American photojournalist Brad Will is splayed out on a sidewalk in Oaxaca, Mexico, mortally wounded by the pistoleros of rogue governor Ulisis Ruiz during tumultuous street battles in that southern city. His killers have never been prosecuted.

Now fast forward to this past January 10th. Manlio Fabio Beltrones, the unctuous leader of the once-ruling (71 years) PRI party faction in the Mexican Senate, announces to a gaggle of reporters that the PRI is prepared to back President Felipe Calderon and his right-wing PAN in passing an “energy reform” package that would permit transnational corporations to generate 49% of the nation’s electricity and open PEMEX, the state petroleum monopoly expropriated from its Anglo-American owners in 1938 and nationalized by President Lazaro Cardenas, to such oil titans as Exxon, British Petroleum, and Shell. Beltrones’ personal preference to initiate the proposed “association of private capitals”: Petrobras, the Brazilian national oil company which opened itself to private investment back in 1997 and which has extensive experience in deep water drilling.

What is the connection between these two apparently unconnected events? Just this: the cover-up of Brad Wills’ death smoothed the way for the PRI-PAN partnership to privatize PEMEX.

Although his killers were plainly identified as plainclothes police on Ulisis’s payroll, Wills’ inconvenient death was ignored by then-president Vicente Fox despite demands by human rights and journalist protection organizations for a full investigation of the killing, one of 26 perpetrated by Ruiz’s death squads between August and October of 2006. Fox’s successor, Felipe Calderon, followed suit and stonewalled an inquiry into Wills’ murder. Similarly, the U.S. Embassy in Mexico never sought justice for a slain citizen despite the personal pleas of the dead man’s family.

Why such studied indifference?

Because holding Governor Ruiz, a prominent PRIista, accountable for the killing(s) would have upset the burgeoning alliance between the PRI and the PAN to ratify Calderon’s legislative agenda, the most pertinent item of which was “energy reform” i.e. the privatization of PEMEX.

Embassy inaction on Brad Wills’ murder followed the same logic. As U.S. ambassador, Bush crony Tony Garza is charged with representing U.S. interests in Mexico and Washington’s interest in opening up Mexican oil to U.S. transnationals far outweighs its interest in bringing the killers of a freelance anarchist reporter to justice. The U.S. has long contemplated a North American Energy Alliance that would guarantee access to Mexican and Canadian reserves.

To this end, Washington has played an active role in facilitating the impending privatization of Petrolios Mexicanos. Over the past months, U.S. transnationals and their associates in government have orchestrated an extraordinary campaign to hoodwink Mexicans into swallowing the lie that PEMEX is hopelessly broken and must be opened to private capital forthwith for the salvation of the Fatherland.

Last July, ex-Federal Reserve czar Alan Greenspan was beamed into Mexico for a teleconference with the nation’s most exalted business council to deliver an ultimatum: if PEMEX was not fixed quickly, the country faced fiscal crisis. Indeed, the petroleum giant (the 11th largest on the planet) generates 40% of Mexico’s total budget and 100% of a social budget that keeps 70,000,000 Mexicans who live in and around the poverty line, in relative quiescence. By “fixing” PEMEX, Greenspan meant privatizing it.

It should be noted that Alan Greenspan is an expert on fiscal crises – his monetary policies just helped to tripwire such a crisis in his own country, the sub-prime disaster.

The Greenspan game plan was echoed December 13th in a memo issued by the International Monetary Fund urgently counseling legislation to allow private capital into PEMEX before the government went broke. Garza’s embassy chimed in the next day, warning of massive capital flight if the Mexican Congress did not pass Calderon’s “energy reform” package. On December 19th, The Economist, which ironically was founded on the fortune reaped by Anglo oil companies in Mexico that eventually became British Petroleum, opined that “the obvious solution to the disaster of PEMEX is to privatize.” Finally, the U.S. Department of Energy delivered the death knell on January 9th: the lack of investment in PEMEX’s Exploration and Exploitation (PEP) division spelled energy catastrophe – not a good sign for Washington’s North American Energy Alliance strategy. On January 10th, the PRI came on board to back Calderon’s “energy reform.”

Despite the Jeremiads, the putsch for privatization has lost considerable steam globally. In fact, a moderate swing to nationalization seems to be in process. Amidst prognoses of irreparable damage to the Venezuelan economy, Hugo Chavez renationalized sectors of PDVSA, the state oil company, and ran a 12% surge in domestic growth in 2007 in spite of it. Bolivia has renationalized natural gas production and Ecuador is on the brink of doing so. The most successful renationalization has been in Putin’s Russia where Gazoprom and Yukos became major world players overnight.

According to Mexican strategic resource writer Alfredo Jalife, 32% of the world’s petroleum supply is in the hands of private transnationals, 20% is nationalized or in the process of being renationalized, and the rest is held by mixed state-private corporations.

But despite their exaggerated anguish at an energy meltdown if PEMEX is not privatized, the doomsayers do have a point: Petrolios Mexicanos is in deep doo-doo. Daily accidents such as the unquenchable fire that took 21 workers’ lives on a Caribbean oil platform and contaminated surrounding waters last fall, pipeline bombings by the guerrilla Popular Revolutionary Army, and the failure to modernize infrastructure – no new refinery has been built in 20 years – is stark evidence of corporate corrosion.

Despite 100-weak-dollar-a-barrel prices (Mexican light crude tops out around $80 USD these days) that generated $2.3 billion in enhanced revenues during the first ten months of 2007, lack of refining capacity forces PEMEX to shell out $5 billion Yanqui dollars each year to import 40% of its gasoline needs – which is to say that for every $1 of the increased revenues PEMEX takes in, two bucks go out for gas.

Calderon’s solution? The so-called “Gasolinazo”, the President’s gift to the driving public on January 6th, the Day of the Kings (Mexican Christmas), that will increase prices at the pump incrementally each month indefinitely. Increased transportation costs are expected to impact food prices across the board.

But the bad news doesn’t stop there. The big battle over Mexican oil is really a battle over crumbs. If U.S. Department of Energy calculations are on target, Mexico only has 12.9 billion barrels in proven reserves, depletion of which could turn PEMEX into a net importer by 2018 if no new petroleum sources are uncorked before then – although Mexico is the sixth largest international oil producer, it has only 1% of the planet’s proven reserves.

With the Cantarell field in the Sound of Campeche, the magnum star of offshore production that has motored PEMEX since the 1990s, just about tapped out, the clock is ticking. To exacerbate this doomsday scenario, Mexico is pumping out what it has left at a record clip to capitalize on the booming barrel price – PEMEX now produces about 3.2 million barrels daily, fully 1.7 million of which are sent up the Gulf to the U.S., an export platform that is accelerating depletion and subsidizing Washington’s wars around the world.

Given this bleak picture, most experts concur that the only place PEMEX can go to drill for new reserves is deep water, five miles down in the Gulf of Mexico. The only catch is that Petrolios Mexicanos does not have deep water drilling capacity. That’s where Petrobras, as contemplated in the PRI/PAN privatization scheme, would come in handy.

What exactly constitutes privatization? Auctioning off the corporation from the top

to the highest bidder or selling it off piece by piece from the bottom? During 35 years of oil boom and bust, PEMEX has systematically dismantled its Exploration & Exploitation division and handed it over to transnational subcontractors, emphasizes Autonomous National University researcher John Saxe- Fernandez who heads up the UNAM’s Strategic Resources Institute. At the top of Saxe-Fernandez’s list of prominent subcontractors is Halliburton with 159 PEMEX contacts since 2000 worth $1.2 billion USD – Halliburton moved into Mexico in the 1990s during the development of Cantarell when Dick Cheney was CEO.

But subcontracting out choice contracts goes back generations. George Bush pere partnered with PEMEX director Jorge Serrano (who later went to jail) in Zapata Offshore, a drilling outfit that operated in the Sound of Campeche in the 1970s. Today, virtually every major transnational driller has a piece of the Mexican action.

A recent daily La Jornada investigation by energy reporter Israel Rodriguez revealed the signing of a series of secret “pre-privatization” covenants to exploit Mexican fields with Shell (the mysterious “Project Margarita”), Exxon, Petrobras, Nexen (Canada), and StatsOil (Norway.) The contracts, accessed through Mexico’s Freedom of Information Act, contained clauses whose contents cannot be divulged for the next five years.

The PRI/PAN energy scam is currently being hatched in the Mexican Senate’s Energy Commission chaired by Francisco Labastida, a former secretary of energy (as is Calderon) and the PRI’s losing presidential candidate in 2000. Those who have gotten a peek at the details label the energy reform legislation “privatization lite” with foot-in-the-door measures that will allow for the “association of private capital” in such areas as pipelines and refineries. The legislation stops short of amending the Mexican Constitution’s Article 27, which stipulates that the petroleum belongs to the nation.

Skirting a constitutional amendment will deny ammo to AMLO – leftist Andres Manuel Lopez Obrador, who many believe was swindled out of the presidency in 2006 and who has emerged as the leader of the fight against privatization. This January, Lopez Obrador announced formation of a cross-party Movement In Defense of Petroleum whose battle cry is “Mexico is not for sale!”

The ex-presidential candidate proposes that PEMEX can raise sufficient revenues without opening itself up to private investment by simply cleaning house – the corporation has long been riddled with corruption, bribe-taking, kickbacks and rampant dirty dealing. For decades, the PRI siphoned off millions to finance its electoral campaigns – in 2000, $110 million USD in PEMEX funds were funneled through the gangster-ridden petroleum workers union into Labastida’s campaign coffers, the so-called “PEMEXgate” scandal.

AMLO has also long advocated the construction of three new refineries to offset the escautf8g cost of importing gasoline which he tags “an absurd situation” for the world’s sixth largest oil producer.

In the opposite corner, Lopez Obrador’s archrival Felipe Calderon insists that opening PEMEX to private capital will somehow make Petrolios Mexicanos “more Mexican” (“more productive, more competitive, more Mexicano.”)

“To hand over our natural resources to foreign powers is an act of treason,” AMLO responds, quoting the man who expropriated and nationalized Mexico’s petroleum in 1938, President Lazaro Cardenas. Lopez Obrador’s defense of Mexican oil will be a first test for the grassroots base the leftist has been cultivating since the tainted 2006 election and is sure to frame the next round of his ongoing bout with Calderon and his allies. AMLO, who in the past has been able to mobilize millions, is calling for nationwide protests this March 18th, the 70th anniversary of Cardenas’s expropriation.

Petroleum is a patriotic fluid here. Expropriation of the oil industry from the “extranjeros” (foreigners, literally “strangers”) was the high point of revolutionary nationalism in Mexico. But in a globalized world, the coming battle around the privatization of PEMEX is not just a Mexican matter anymore and, indeed, has far-reaching implications for the future of neo-liberalism in the Americas.

Sprawled in the Oaxaca street, the life blood leaking from him, the last thing Brad Will could have imagined is that in death he would become an accidental pawn to the transnationals’ ambitions to privatize Mexican oil. Tragically, in the end, that may be Wills’ most significant legacy.

TECHSPLOITATION Six years ago I wrote a column titled "Blog Anxiety," which was all about how bloggers make me nervous and jealous with their lightning-fast news cycles. I bemoaned my inability to commit words to public record without waiting for editorial oversight and without waiting for publication day (inevitably several days if not weeks after I had written those words). I talked about how bloggers can cite sources they’ve talked to informally and how they seem blissfully unburdened by concerns about injecting a personal perspective into their writing.

That was before It All Changed. And by "It All Changed," I don’t just mean that I became a blogger, which I did. More profoundly, I mean that blogs themselves have changed.

They are not the subterranean upstart media without rules anymore. I’m certainly not the first person to observe that blogs are fast becoming indistinguishable from mainstream media, and indeed places like the New York Times and the Washington Post have blogs that are often more newsy than the papers themselves. This blurring between formerly mainstream media and formerly alternative media means that the upstarts are having to follow old-school rules.

While I can’t speak for all bloggers, I prefer not to publish anything on my blog that hasn’t been edited. I don’t want readers to see my spelling errors and craptastic leaps in logic, thank you very much (of course you’ll still see many, but not as many as you would if there were no edits). I also spend a fair amount of time on the phone or on e-mail interviewing sources for my posts, as well as doing research. And I won’t publish anything that I think will get me sued, is libelous, or is just plain wrong, even if it’s funny. What I’m saying is that my blog is not exactly the unedited, stream-of-consciousness outpourings of a person in pajamas. Well, OK, I am often in pajamas.

Recently I was reading a conversation thread on Metafilter, one of my favorite still-subterranean Web sites for smart talk and slagging. Somebody mentioned my science fiction blog io9.com, then snarked at me for starting a blog when I was on record saying that blogs freak me out. An unedited discussion full of spiky banter and maniacal analysis followed — exactly the kind of conversation I once associated with all blogs. People were nastier than they would have been if writing for a mainstream publication, but the cool ideas–to–noise ratio was nevertheless far higher than you’d ever get in USA Today or CNN.

And this brings me to what scares me about blogs now. I worry that instead of taking the Metafilter ethos mainstream, many blogs are leaving it behind. That’s not because we have editors or talk to sources — I’m happy to see bloggers doing that. It’s because our audiences are starting to be as big as those of the mainstream media, and the mainstream media have taught us to be afraid of saying what we really think to those audiences. They’ve taught us that we should tiptoe around hot-button issues like climate change and sex and delay publishing stories that might upset the government until such a time as the government is comfortable with those stories.

This is the source of my blog anxiety in 2008. Will blogs take on all the bad habits of the mainstream media, self-censoring when we should be publishing? Or will bloggers help the media progress just a little bit further toward independence of thought and bravery in publication?

It’s still too early to tell. Even the most mainstream blogs don’t suffer the same pressures that mainstream publications like the New York Times do. Blogs don’t have the 100-year histories of many newspapers and magazines — they don’t have the huge staffs and long, elaborate relationships with corporations and governments and famous, influential people. And I am glad we don’t have that history. I hope we can make our own, new history and shake up the way news is made and culture is analyzed. And then, in 30 years, I hope a new medium will come along and kick our asses too. *

President, Democrat

BARACK OBAMA


This is now essentially a two-person race for the Democratic nomination, and no matter how it comes down, it’s a historic moment: neither of the front-runners for the White House (and by any standard, the Democratic nominee starts off as the front-runner) is a white man. And frankly, the nation could do a lot worse than either President Hillary Clinton or President Barack Obama.

But on the issues, and because he’s a force for a new generation of political activism, our choice is Obama.

Obama’s life story is inspirational, and his speeches are the stuff of political legend. He can rouse a crowd and generate excitement like no presidential candidate has in many, many years. He has, almost single-handedly, caused thousands of young people to get involved for the first time in a major political campaign.

The cost of his soaring rhetoric is a disappointing lack of specific plans. It can be hard at times to tell exactly what Obama stands for, exactly how he plans to carry out his ambitious goals. His stump speeches are riddled with words like change and exhortations to a new approach to politics, but he doesn’t talk much, for example, about how to address the gap between the rich and the poor, or how to tackle urban crime and poverty, or whether Israel should stop building settlements in the occupied territories.

In fact, our biggest problem with Obama is that he talks as if all the nation needs to do is come together in some sort of grand coalition of Democrats and Republicans, of "blue states and red states." But some of us have no interest in making common cause with the religious right or Dick Cheney or Halliburton or Don Fisher. There are forces and interests in the United States that need to be opposed, defeated, consigned to the dustbin of history, and for all of Obama’s talk of unity, we worry that he lacks the interest in or ability to take on a tough, bloody fight against an entrenched political foe.

Still, when you look at his positions, he’s on the right track. He wants to raise the cap on earnings subject to Social Security payments (right now high earners don’t pay Social Security taxes on income over $97,000 a year). He wants to cut taxes for working-class families and pay for it by letting the George W. Bush tax cuts on the rich expire (that’s not enough, but it’s a start). He wants to double fuel-economy standards. His health care plan isn’t perfect, but it’s about the same as all the Democrats offer.

And he’s always been against the war.

It’s hard to overstate the importance of that. Obama spoke out against the invasion when even most Democrats were afraid to, so he has some credibility when he says he’s going to withdraw all troops within 16 months and establish no permanent US bases in Iraq.

Hillary Clinton has far more extensive experience than Obama (and people who say her years in the White House don’t count have no concept of the role she played in Bill Clinton’s administration). We are convinced that deep down she has liberal instincts. But that’s what’s so infuriating: since the day she won election to the US Senate, Clinton has been trianguutf8g, shaping her positions, especially on foreign policy, in an effort to put her close to the political center. At a time when she could have shown real courage — during the early votes on funding and authorizing the invasion of Iraq — she took the easy way out, siding with President Bush and refusing to be counted with the antiwar movement. She has refused to distance herself from such terrible Bill Clinton–era policies as welfare reform, the North American Free Trade Agreement, and don’t ask, don’t tell. We just can’t see her as the progressive choice.

We like John Edwards. We like his populist approach, his recognition that there are powerful interests running this country that won’t give up power without a fight, and his talk about poverty. In some ways (certainly in terms of campaign rhetoric) he’s the most progressive of the major candidates. It is, of course, a bit of a political act — he was, at best, a moderate Southern Democrat when he served in the Senate. But at least he’s raising issues nobody else is talking about, and we give him immense credit for that. And we’ve always liked Dennis Kucinich, who is the only person taking the right positions on almost all of the key issues.

But Edwards has slid pretty far out of the running at this point, and Kucinich is an afterthought. The choice Californians face is between Hillary Clinton and Barack Obama. And Obama, for all of his flaws, has fired up a real grassroots movement, has energized the electorate, and is offering the hope of a politics that looks forward, not back. On Feb. 5, vote for Barack Obama.

President, Republican

RON PAUL


We have a lot of disagreements with Ron Paul and his libertarian worldview. He opposes the taxes that we need to make civil society function and the government regulations that are essential to protecting the most powerless members of society. From its roots in the Magna Carta and Adam Smith’s economic theories to the Bill of Rights, it’s clear the United States was founded on a social compact that libertarians too often seem to deny. And Paul compounds these ills in the one area in which he departs from the libertarians: he doesn’t support federal abortion rights. He’s been associated with some statements that are racially insensitive (to say the least). He clearly shouldn’t be president.

But he won’t — Paul isn’t going to win the nomination. So it’s worthwhile endorsing him as a protest vote for two reasons. His presence on the ballot serves to show up some of the hypocrisies of the rest of the GOP field — and he is absolutely correct and insightful on one of the most important issues of the day: the war.

Paul is alone among the Republican candidates for president in sounding the alarm that our country is pursuing a dangerous, shortsighted, hypocritical, expensive, and ultimately doomed strategy of trying to dominate the world militarily. He opposed the invasion of Iraq and thinks the US should pull out immediately. It’s immensely valuable to have someone like that in the GOP debates, speaking to the conservative half of our country about why this policy violates the principles they claim to hold dear.

Paul is absolutely correct that if we stopped trying to police the world, ended the war on drugs, and quit negotiating trade deals that favor multinational corporations over American families and workers, we would be a far more free and prosperous nation.

President, Green

CYNTHIA MCKINNEY


We endorsed Ralph Nader for president in 2000, in large part as a protest vote against the neoconservative politics of the Bill Clinton administration (the North American Free Trade Agreement, the General Agreement on Tariffs and Trade, welfare "reform," etc.). And Nader’s Green Party campaign had a place (particularly in a state the Democrats were going to win anyway). We’ve never been among those who blame Nader for Al Gore’s loss — Gore earned plenty of blame himself. But four years later we, like a lot of Nader’s allies and supporters, urged him not to run — and he ignored those pleas. Now he may be seeking the Green Party nomination again. Nader hasn’t formally announced yet, but he’s talking about it — which means he still shows no interest in being accountable to anyone. It’s too bad he has to end his political life this way.

Fortunately, there are several other credible Green Party candidates. The best is Cynthia McKinney, the former Georgia congressional representative, who has switched from the Democratic to the Green Party and is seeking a spot on the top of the ticket. McKinney has her drawbacks, but we’ll endorse her.

The real question here is not who would make a better president (that’s not in the cards, of course) but who would do more to build the Green Party and promote the best course for a promising third party that still hasn’t developed much traction as a national force. We’ve been clear for years that the Greens should be working from the grass roots up: the party’s first priority should be electing school board members, community college board members, members of boards of supervisors and city councils. Over time, leaders like Mark Sanchez, Jane Kim, Matt Gonzalez, and Ross Mirkarimi can start competing for mayor’s offices and posts in the State Legislature and Congress. Running a presidential candidate only makes sense as part of a party-building operation. (That’s what Nader did in 2000, and for all the obvious reasons he’s incapable of doing it today.)

But the Greens insist on running candidates for president, so we might as well pick the best one.

McKinney has a lot to offer the Greens. She’s an experienced legislator who has won several tough elections and taken on a lot of tough issues. As an African American woman from the South, she can also broaden the party’s base. She was a solid progressive in Congress, where she was willing to speak out on issues that many of her colleagues ducked (she was, for example, one of the few members to push for an impeachment resolution).

McKinney has her downside — in recent years she’s been flirting with the loony side of the left, getting a bit close to some Sept. 11 conspiracy theories that hurt her credibility (although she’s also made some very good points about the attacks and the lack of a serious investigation into what happened). And some of her supporters have made alarmingly anti-Semitic statements (from which, to her credit, she has attempted to distance herself). But she has to come out now, strongly, to denounce those sorts of comments and show that she can build a real coalition.

With those (serious) reservations, we’ll give her the nod.

Proposition 91 (use of gas tax)

NO


Prop. 91 is essentially an effort to ensure that revenue from the state’s gas tax goes only to roads and highways. It’s a moot point anyway: Proposition 1A, which passed last year, did the same thing, and now even proponents of 91 are urging a No vote.

But we’re going to take this opportunity to reiterate our opposition to Prop. 1A, Prop. 91, and any other ridiculous effort to restrict the use of gasoline tax revenues.

It should be clear to everyone at this point that the widespread overuse of automobiles is having far bigger impacts on California than just wear and tear on the roads. Cars are the biggest single cause of global warming, and they kill and injure more Californians than guns do, causing enormous costs that are borne by all of us. Driving a car is expensive for society, and drivers ought to be paying some of those costs. That should mean extra gas taxes and a reinstatement of the vehicle license fee to previous levels (and extra surcharges for those who drive Hummers and other especially wasteful, dangerous vehicles). That money ought to go to the state General Fund so California doesn’t have to close state parks and slash spending on schools and social services, as Gov. Arnold Schwarzenegger is proposing.

Proposition 92 (community college funding)

YES


Prop. 92 is another example of how desperate California educators are and how utterly dysfunctional the state’s budget process has become.

The measure is complicated, but it amounts to a plan to guarantee community colleges more money — a total of about $300 million a year — and includes provisions to cut the cost of attending the two-year schools. Those are good things: community colleges serve a huge number of students — about 10 times as many as the University of California system — many of whom come from lower-income families who can’t afford even a small fee increase. And, of course, as the state budget has gotten tighter, community college fees have gone up in the past few years — and as a result, attendance has dropped.

Part of the way Prop. 92 cuts fees is by divorcing community college funding from K–12 funding — and that’s created some controversy among teachers. Current state law requires a set percentage of California spending (about 40 percent) to go to K–12 and community college education, but there’s no provision to give more money to the community colleges when enrollment at those institutions grows faster than K–12 enrollment.

Some teachers fear that Prop. 92 could lead to decreased funds for K–12, and that’s a real concern. In essence, this measure would add $300 million to the state budget, and it includes no specific funding source. This worries us. In theory, the legislature and the governor ought to agree that education funding matters and find the money by raising taxes; in practice, this could set up more competition for money between different (and entirely worthy) branches of the state’s public education system — not to mention other critical social services.

But many of the same concerns were voiced when Prop. 98 was on the ballot, and that measure probably saved public education in California. The progressives on the San Francisco Board of Education all support Prop. 92, and so do we. Vote yes.

Proposition 93 (term limits)

YES


This is pathetic, really. The term-limits law that voters passed in 1990 has been bad news, shifting more power to the governor and ensuring that the State Assembly and the State Senate will be filled with people who lack the experience and institutional history to fight the Sacramento lobbyists (who, of course, have no term limits). But the legislature isn’t a terribly popular institution, and the polls all show that it would be almost impossible to simply repeal term limits. So the legislature — led by State Assembly speaker Fabian Núñez, who really, really wants to keep his job — has proposed a modification instead.

Under the current law, a politician can serve six years — three terms — in the assembly and eight years — two terms — in the senate. Since most senators are former assembly members, that’s a total of 14 years any one person can serve in the legislature.

Prop. 93 would cut that to 12 years — but allow members to serve them in either house. So Núñez, who will be termed out this year, could serve six more years in the assembly (but would then be barred from running for the senate). Senators who never served in the assembly could stick around for three terms.

That’s fine. It’s a bit better than what we have now — it might bring more long-term focus to the legislature and eliminate some of the musical-chairs mess that’s brought us the Mark Leno versus Carole Migden bloodbath.

But it’s sad that the California State Legislature, once a model for the nation, has been so stymied by corruption that the voters don’t trust it and the best we can hope for is a modest improvement in a bad law. Vote yes.

Propositions 94, 95, 96, and 97 (Indian gambling compacts)

NO


We supported the original law that allowed Indian tribes to set up casinos, and we have no regrets: that was an issue of tribal sovereignty, and after all the United States has done to the tribes, it seemed unconscionable to deny one of the most impoverished populations in the state the right to make some money. Besides, we’re not opposed in principle to gambling.

But this is a shady deal, and voters should reject it.

Props. 94–97 would allow four tribes — all of which have become very, very wealthy through gambling — to dramatically expand the size of their casinos. The Pechanga, Morongo, Sycuan, and Agua Caliente tribes operate lucrative casinos in Southern California, spend a small fortune on lobbying, and convinced Gov. Arnold Schwarzenegger to give them permission to create some of the largest casinos in the nation. Opponents of this agreement have forced the issue onto the ballot.

The tribes say the deals will bring big money into the state coffers, and it’s true that more gambling equals more state revenue. But the effective tax rate on the slot machines (and this is all about slot machines, the cash engines of casinos) would be as little as 15 percent — chump change for a gambling operation. And none of the other tribes in the state, some of which are still desperate for money, would share in the bounty.

The big four tribes refuse to allow their workers to unionize. While we respect tribal sovereignty, the state still has the right to limit the size of casinos, and if the tribes want the right to make a lot more money, they ought to be willing to let their workers, not all of them Indians, share in some of the rewards. We’re talking billions of dollars a year in revenue here; paying a decent salary is hardly beyond the financial ability of these massive operations.

The governor cut this deal too fast and gave away too much. If the tribes want to expand their casinos, we’re open to allowing it — but the state, the workers, and the other tribes deserve a bigger share of the revenue. Vote no on 94-97.

Proposition A (neighborhood parks bond)

YES


This $185 million bond has the support of a broad coalition of local politicians and activists, Mayor Gavin Newsom, and every member of the Board of Supervisors. It would put a dent in the city’s serious backlog of deferred maintenance in the park system.

The measure would allocate $117.4 million for repairs and renovations of 12 neighborhood parks, selected according to their seismic and safety needs as well as their usage levels. It would also earmark $11.4 million to replace and repair freestanding restrooms, which, the Recreation and Park Department assures us, will be kept open seven days a week.

The bond also contains $33.5 million for projects on Port of San Francisco land, including a continuous walkway from Herons Head Park to Pier 43 and new open spaces at regular intervals along the eastern waterfront. While some argue that the Port should take care of its own property, it’s pretty broke — and there’s a growing recognition that the city’s waterfront is a treasure, that open space should be a key component of its future, and that it doesn’t really matter which city agency pays for it. In fact, this bond act would provide money to reclaim closed sections of the waterfront and create a Blue Greenway trail along seven miles of bay front.

One of the more questionable elements in this bond is the $8 million earmarked for construction and reconstruction of city playfields — which includes a partnership with a private foundation that wants to install artificial turf. There’s no question that the current fields are in bad repair and that users of artificial turf appreciate its all-weather durability. But some people worry about the environmental impact of the stuff, which is made from recycled tires, while others wonder if this bond will end up giving control of 7 percent of our parkland to the sons of Gap founder Don Fisher (their City Fields Foundation is the entity contributing matching funds for city-led turf conversions). Although the Rec and Park Department has identified 24 sites for such conversions, none can take place without the Board of Supervisors’ approval — and the supervisors and the Rec and Park Commission needs to make it clear that if neighbors don’t want the artificial turf, it won’t be forced on them.

Prop. A also earmarks $5 million for trail restoration and $5 million for an Opportunity Fund, from which all neighborhoods can leverage money for benches and toilets through in-kind contributions, sweat equity, and noncity funds.

And it includes $4 million for park forestry and $185,000 for audits.

With a 2007 independent analysis identifying $1.7 billion in maintenance requirements, this is little more than a start, and park advocates need to be looking for other, ongoing revenue sources. But we’ll happily endorse Prop. A.

Proposition B (deferred retirement for police officers)

YES


We’ve always taken the position that relying exclusively on police officers to improve public safety is as useless as simply throwing criminals behind bars — it’s only part of the solution and will never work as an answer all on its own.

But we’re also aware that the city is suffering a dramatic shortage of police officers; hundreds are expected to retire within a few short years, and those figures aren’t being met by an equal number of enrollees at the academy.

So we’re supporting Prop. B, even if it’s yet another mere stopgap measure the police union has dragged before voters, and even though the San Francisco Police Officers Association is often hostile to attempted law enforcement reforms and is never around when progressives need support for new revenue measures.

Prop. B would allow police officers who are at least 50 years of age and who have served for at least 25 years to continue working for three additional years with their regular pay and benefits while the pension checks they’d have otherwise received collect in a special account with an assured annual 4 percent interest rate.

The POA promises Prop. B will be cost neutral to taxpayers, and the city controller will review the program in three years to ensure that remains the case. Also at the end of three years, the Board of Supervisors, with a simple majority vote, could choose to end or extend it.

POA president Gary Delagnes added during an endorsement interview that department staffers in San Francisco who reach retirement age simply continue working in other police jurisdictions. If that’s the case, we might as well keep them here.

No other city employees are eligible for such a scheme, which strikes us as unfair. And frankly, one of the main reasons the city can’t hire police officers is the high cost of living in San Francisco — so if the POA is worried about recruitment, the group needs to support Sup. Chris Daly’s affordable-housing measure in November.

But we’ll endorse Prop. B.

Proposition C (Alcatraz Conversion Project)

NO


We understand why some people question why a decaying old prison continues to be a centerpiece of Bay Area tourism. A monument to a system that imprisoned people in cold, inhumane conditions doesn’t exactly mesh with San Francisco values.

But the Alcatraz Conversion Project, which proposes placing a half–golf ball–like Global Peace Center atop the Rock, is a wacky idea that looks and sounds like a yuppie tourist retreat and does little to address the island’s tortured past. People don’t have to support everything with peace in the title.

The proposal includes a white domed conference center for nonviolent conflict resolution, a statue of St. Francis, a labyrinth, a medicine wheel, and an array of what proponents call "architecturally advanced domed Artainment multimedia centers."

We agree with the ideal of dedicating the island to the Native Americans who fished and collected birds’ eggs from this once guano-covered rock for thousands of years and whose descendants carried out a bold occupation at the end of the 1960s. But this proposal seems based on wishful thinking, not fiscal or environmental realities.

The plan is backed by the Global Peace Foundation, which is a branch of the San Francisco Medical Research Foundation, a Mill Valley nonprofit founded by Marin resident and Light Party founder Da Vid. It’s just goofy. Vote no.

“Insurance is not care.”

If you want a little perspective on the Governor’s health plan, take a minute and read this amazing story (thanks, Calitics) about a massive protest organized to get a desperately ill 17-year-old girl a liver transplant. The liver was available; the doctors were ready. The insurance company wouldn’t pay for it.

Here’s what Rose Ann DeMoro of the California Nurses Association had to say:

“Every politician who thinks the answer to our healthcare crisis is more insurance should stop and think about Nataline Sarkysian,” said DeMoro. “Insurance is not care. Paying for insurance coverage is not the same as assuring you will receive appropriate care, even when recommended by a physician as it was for Nataline. Insurance corporations profit by denying care to the sick, and that is no way to run a humane healthcare system.”

I hope the California state Senate is listening.

Polishing SPUR

Wedged among the commerce, tourism, and white-collar businesses north of Market Street is the slim entry to 312 Sutter, easy to miss unless you happen to be searching for the San Francisco Planning and Urban Research Association. SPUR occupies the fourth and fifth floors of the building — and occupies them completely. Cubicles are close and overstuffed. Conversations compete. Space for meetings is a hot commodity. Four bicycles, ridden to work by staff members, are crammed in a side room where languish a half century’s worth of policy papers, photographs, and planning documents generated by the active public interest think tank.

It looks more like a struggling nonprofit than one of the most influential policy organizations in town, one supported by the city’s richest and most powerful interests.

"This is why we’re building the Urban Center," said Gabriel Metcalf, the youthful executive director of the 48-year-old organization, clad in a dark suit and sipping from a Starbucks coffee cup while he roams the fourth floor office space searching for any available real estate to sit and talk.

He settles on an open-faced workroom with empty seats. They circle a table covered with a thick ledger of plans for SPUR’s new Urban Center, a $16.5 million, 12,000-square-foot four-story building at 654 Mission that the group is building with more than $8 million in public money.

Plans for the center include a free exhibition space, a lending library, and an evolution of the group’s current public education program, now consisting of noontime forums, to include evening lectures and accredited classes. Though the center will house meeting rooms for SPUR’s committees and offices for its staff, the suggestion is that the new space will be a more public place.

And SPUR seems to be searching for a new public image.

For years the organization was synonymous with anything-goes development, ruinous urban renewal, and an economy policy that favored big business and growth at all costs. Today SPUR’s staffers and some board members present a different face. The new SPUR features open debate and seeks consensus; phrases like sustainability and public interest are bandied about more than tax cuts and urban renewal.

But San Francisco progressives are a tough crowd, and SPUR’s history — and, frankly, most of its current political stands — makes a lot of activists wonder: Has SPUR really changed its spurs? And can a group whose board is still overwhelmingly dominated by big business and whose biggest funders are some of the most powerful businesses in town ever be a voice of political reason?

As one observer wryly noted, "I’ve yet to see SPUR publicly denounce a development project."

SPUR considers itself a public policy think tank, a term that conjures an impression of lofty independence. But the group has, and has always had, a visible agenda. SPUR members regularly advocate positions at public meetings, and the group takes stands on ballot measures.

And it has a painful legacy. "We have a dark history," Metcalf admits, referring to the days when "UR" stood for "urban renewal," often called "urban removal" by the thousands of low-income, elderly, and disabled people, many African American and Asian, who were displaced by redevelopment in San Francisco.

That history — and the fact that SPUR’s membership is largely a who’s who of corporations, developers, and financiers — has caused some to raise questions about the public money the group has received for the new Urban Center.

"They’re not an academic institution," said Marc Salomon, a member of the Western SoMa Citizens Planning Task Force who’s butted heads with the group. "There’s no academic peer review going on here. The only peer review is coming from the people who fund them."

Yet prominent local progressives like artist and planning activist Debra Walker, veteran development warrior Brad Paul, and architect and small-business owner Paul Okamoto have joined the SPUR board in recent years. "There’s a bunch of us that have come in under the new regime of Gabriel Metcalf because there’s a real aching need for a progressive dialogue about planning," said Walker, who thinks SPUR is making concerted efforts to inform its policies with the points of view of a broader constituency. "I think SPUR is engaged in those conversations more than anyone."

SPUR defines its mission as a commitment to "good planning and good government." Though a wide range of issues can and does fall under that rubric, the 71 board members and 14 staff tend to focus on housing, transportation, economics, sustainability, governmental reform, and local and regional planning, and their agenda has a dogged pro-growth tinge.

SPUR likes to trace its history to the post–1906 earthquake era, when the literal collapse of housing left many people settling in squalid conditions. The San Francisco Housing Association was formed "to educate the public about the need for housing regulations and to lobby Sacramento for anti-tenement legislation." A 1999 SPUR history of itself places its genesis in the Housing Association, though other versions of the group’s history suggest a slightly different taproot.

According to Chester Hartman’s history of redevelopment in San Francisco, City for Sale (University of California Press, 2002), the 1950s were a time when corporate-backed regional planners were envisioning a new, international commercial hub in the Bay Area. They were looking for a place to put the high-rise office buildings, convention centers, and hotels that white-collar commerce would need. Urban renewal money and resources were coming to the city, and San Francisco’s Redevelopment Agency identified the Embarcadero and South of Market areas as two of several appropriate places to raze and rebuild.

The agency, however, was dysfunctional and couldn’t seem to get plans for the Yerba Buena Center — a convention hall clustered with hotels and offices — off the ground. The Blyth-Zellerbach Committee, "a group the Chamber of Commerce bluntly described as ‘San Francisco’s most powerful business leaders, whose purpose is to act in concert on projects deemed good for the city,’<0x2009>" as Hartman writes, commissioned a report in 1959 by Aaron Levine, a Philadelphia planner, which identified the Redevelopment Agency as one of the worst in the nation and recommended more leadership from the business community. The San Francisco Planning and Urban Renewal Association was born, funded by Blyth-Zellerbach, whose leaders included some corporations that still pay dues to SPUR, like Bechtel, Bank of America, Wells Fargo, and Pacific Gas and Electric Co.

John Elberling, a leader of the Tenants and Owners Development Corp., a group representing the people who were trying to stay in the area, was one of many activists who litigated against the city’s plan and managed to wedge some affordable housing into the developers’ vision of South of Market. SPUR, he told us, was "explicitly formed to support redevelopment issues in the ’60s and ’70s."

By 1974, when Paul began fending off redevelopment efforts around the Tenderloin and directed the North of Market Planning Coalition, "all through that period SPUR was viewed by the community as a tool for the Chamber of Commerce," he said.

In 1976, "Urban Renewal" became "Urban Research," a move away from the tarnished term. The 1999 commemoration of SPUR’s 40th anniversary is a somewhat sanitized history that never presents the faces of the people who were displaced by the program; nor does the analysis nod significantly toward the neighborhood groups and activists who were able to mitigate the wholesale razing of the area.

That’s still a soft spot for SPUR, some say. "They’re uncomfortable with questions of class. Those questions tend to be glossed over," said Tom Radulovich, executive director of Livable City and a SPUR board member from 2000 to 2004.

Metcalf doesn’t duck the issue. "If you’re a city planner, you’ve got to meditate deeply on urban renewal, even though you didn’t do it. It’s the only time in urban history that planners were given power, and that’s what they did with it," he said.

Besides a long friendship with powerful businesses, SPUR has frequently enjoyed an intimate relationship with city hall. "They morphed in the ’80s into a good-government, good-planning group, but in fact they were really tight with the [Dianne] Feinstein administration," Elberling said. "One of the ways you got to be a city commissioner was by being a member of SPUR. Feinstein’s planning and development club was SPUR."

Mayor Feinstein’s reign is often remembered as a boom in downtown development — at least until 1985, when San Franciscans for Reasonable Growth succeeded in passing Proposition M, a measure severely limiting annual high-rise development. SPUR opposed the measure and still supports increased height and density along transit corridors in the city.

"SPUR always goes with more," Radulovich said. "Sometimes there’s a trade-off between sustainability and growth, and I don’t have much confidence they won’t go with growth."

A March SPUR report, "Framing the Future of Downtown San Francisco," is one example of a cognizance of other options, weighing the pros and cons of expanding the central business district or transforming it into a "central social district": "While office uses remain, the goal of a CSD is to create a mixed-use, livable, 24-hour downtown neighborhood." Another line in the report offers a telling look at how SPUR thinks: "Economic growth in the CSD model may be diminished as the remaining sites for office buildings become used for new residential, retail, or other non-office uses."

Retail means, in fact, economic growth. A 1985 Guardian-commissioned study of small businesses in San Francisco, "The End of the High-Rise Jobs Myth," found that most of the new jobs created in the city between 1980 and 1984 were not in the downtown office high-rises but around them. Businesses with fewer than 99 employees had generated twice as many jobs as those with more employees.

While the numbers may be different today, the concept that neighborhood-serving retail keeps a local economy healthy has only grown stronger, as has public sentiment against chain stores. Yet SPUR opposed a proposition calling for conditional-use permits for formula retail, which voters approved in 2006.

Over the years SPUR’s political record has been checkered. Though the group talks the good-government talk, it opposed propositions establishing the city’s Ethics Commission and reforming the city’s Sunshine Ordinance. According to Charley Marsteller, a founder of Common Cause and a longtime good-government advocate in San Francisco, "Common Cause supported initiatives in 1995, 1997, 1999, 2000, 2002, and 2005. SPUR opposed all of them."

This November, SPUR came out in favor of Proposition C, which calls for public hearings before measures can be placed on the ballot, but opposed Question Time for the mayor. The group gave a yes to the wi-fi policy statement and approved establishing a small-business assistance center — contrary to past stances.

SPUR isn’t afraid to defend its positions. "Those who disagree with a conclusion SPUR reaches object to us presenting our ideas as objectively true rather than as values based," Metcalf notes in the May SPUR report "Civic Planning in America," in which he surveys other similar organizations.

"And in truth, evidence and research seldom point necessarily to one single policy outcome, except when viewed through the lens of values. We want to stop sprawl. We want housing to be more affordable. We want there to be prosperity that is widely shared…. Perhaps it’s time to grow more comfortable with using this language of values," he writes.

Paul, who’s now program director for the Haas Jr. Fund and has served on the SPUR board for seven years, says the group is indeed changing. "Over the last six to eight years I’ve noticed a real shift on the board," he said. "We have really intense and interesting discussions about issues. People feel they can speak their mind."

Okamoto, a partner in the Okamoto Saijo architectural firm, thinks this is the result of a fundamental shift in planning tactics, due to a more recent and deeper comprehension of the coming environmental crises. "Global climate change is moving things. I think SPUR’s going in the same direction," he said. Okamoto joined SPUR "because I’d like to see if I could influence the organization toward sustainability. Now we have a new funded staff position for that topic."

And yet the fact remains that only 5 of the 71 board members — about 7 percent — can be described as prominent progressives. At least half are directly connected to prominent downtown business interests.

And a list of SPUR’s donors is enough to give any progressive pause. Among the 12 biggest givers in 2006 are Lennar Corp., PG&E, Wells Fargo, Westfield/Forest City Development, Bechtel, Catellus, and Webcor.

In the past 10 years SPUR’s staff has doubled, signaling a subtle shift away from relying mainly on the research and work of board members. One of the newest positions is a transportation policy director, and that job has gone to Dave Snyder, who helped revive the San Francisco Bicycle Coalition in 1991, founded Livable City, and spent seven years on SPUR’s board before taking the job.

Having occupied the new post for a year, he said, "If I left, it wouldn’t be because I didn’t like SPUR. The debates we have at the staff level are more open than I expected."

Proposition A, the November transportation reform measure, is one example of the group’s new approach. The group voted a month earlier than usual to endorse a measure that was directly in opposition to the interests of one of its biggest funders, Gap billionaire Don Fisher (the Gap is also a member of SPUR). According to Walker, when the SPUR board vetted the endorsements the number of no votes for Prop. A was in the single digits. "I was so surprised," she said.

SPUR opposed Proposition H, a pro-parking countermeasure largely funded by Fisher, and worked with progressives on the campaign.

Metcalf noted it was the ground troops who made all the difference. "We don’t have [that kind of] power, and there are other groups that do. We wrote it, but we didn’t make it win. The bike coalition and [Service Employees International Union Local 1021] did," he said.

Sup. Aaron Peskin, who brokered much of the Prop. A deal, called it a sign of change for SPUR. "They probably lost a lot of their funders over this."

Radulovich is still dubious. He jumped ship after witnessing some disconnects between the board and its members. Though SPUR asks members to check their special interests at the door, Radulovich couldn’t say that always happened and recalled an example from an endorsement meeting at which a campaign consultant made an impassioned speech for the campaign on which he was working.

As far as his board membership was concerned, Radulovich said, "there were times I definitely felt like a token…. Development interests and wealthy people were much better represented."

Some say that isn’t about to change. "SPUR has been, is, and I guess always will be the rational front for developers," said Calvin Welch, a legendary San Francisco housing activist. "The members of SPUR are real estate lawyers, professional investors, and developers. Its original function was to be the Greek chorus for urban renewal and redevelopment."

Welch and Radulovich agree SPUR doesn’t represent San Franciscans, and Welch suggests the Dec. 4 Board of Supervisors hearing on an affordable-housing charter amendment was a case in point. "The people who got up to speak, I’d argue that’s San Francisco, and it doesn’t look a fucking thing like SPUR."

SPUR recently applied for a tax-exempt bond capped at $7 million from the California Municipal Finance Authority to help pay the cost of SPUR’s new Urban Center. It’s a standard loan for a nonprofit — SPUR is both a 501(c)(3) and 501(c)(4) — but some neighborhood activists raised questions about whether SPUR’s project is an appropriate expense for taxpayer cash.

"There’s no city money going toward the Urban Center, but by using tax-exempt bond financing they’re depriving the US Treasury of tax revenues," Salomon said. "The people who are funding SPUR can afford to buy them a really nice building, with cash."

The Urban Center also received a $231,000 federal earmark from Rep. Nancy Pelosi, whose nephew Laurence Pelosi is a former SPUR board member. Another $967,500 will come to SPUR from the California Cultural and Historical Endowment, which voters set aside through Proposition 40 to fund projects that "provide a thread of California’s cultural and historical resources."

Metcalf said SPUR isn’t sitting on a pile of cash: "We’re not that wealthy. We just don’t have that level of funding." The group’s endowment is small, and according to its 2006 annual report, revenues were $1.8 million, 90 percent of that from memberships and special events. The annual Silver Spur Awards, at which the group celebrates the work of local individuals, from Feinstein to Walter Shorenstein to Warren Hellman, is one of the biggest cash cows for SPUR, typically netting more than half a million dollars.

So far most of the funds for the Urban Center have come from donations raised from board members, individuals, businesses, and foundations. Metcalf defends the use of public funds. "For a group like SPUR that needs to be out in front on controversial issues, our work depends on having a diverse funding base. The Urban Center is part of that," he said.

The new headquarters is modeled on similar urban centers in Paris and New York, places that invite the public to view exhibits and get involved in answering some of the bigger planning questions cities are facing as populations increase and sprawl reigns. According to SPUR, this will be the first urban center west of Chicago, and the doors should open in 2009.

Walker, who’s been a board member for about a year, isn’t ready to say SPUR has been transformed. "It’s in my bones to be skeptical of SPUR," she said. "I have a different perspective than most of the people who are on SPUR, but the membership is different from the people who are funding it. I still think we need to have a more progressive policy think tank as well."

Walker recruits for SPUR’s membership development committee and said some of her suggestions have been well received. "The reality is, the progressive community is really powerful here when we come together and work on stuff. You can’t ignore us. Rather than fight about it, SPUR is offering some middle ground."

Fix the Prop. A cab problem

EDITORIAL The politics of Proposition A were pretty clear: the Muni reform measure had the backing of nearly every environmental and labor group in the city and was a direct alternative to the pro-car, pro-parking disaster that was Proposition H, pushed by Republican billionaire Don Fisher.

The policy is a little more complicated.

For the most part, Prop. A is a solid piece of legislation that will lead to some significant, if not earth-shaking, improvements in public transit. It has one serious flaw, though — it could lead to the demise of the city’s taxi medallion system, which was designed to keep the valuable operating permits in the hands of working drivers.

During the campaign, Sup. Aaron Peskin, the sponsor of Prop. A, told us that if the measure passed, he’d craft legislation to fix the cab problem. He should get going on that right away.

San Francisco has an unusual system of allocating taxi permits. Since 1978, when Proposition K (authored by then-supervisor Quentin Kopp) became law, only people who drive cabs are allowed to hold medallions. They can’t be sold or transferred in any way, and corporations can’t own them. That reform made it possible for drivers to share in the profits that come from holding the medallions — and the cab companies have been trying to repeal it ever since. Eight times in the past 30 years, corporate-led efforts to overturn Prop. K have failed.

The system isn’t perfect — it takes up to 15 years to qualify for a medallion, and some people on the wait list stopped driving cabs long ago. There are scams and cheaters. But overall, the notion that drivers — not cab companies, not investors, not giant conglomerates — have the exclusive right to the valuable permits is a good one, and it needs to be protected.

But there’s some fairly broad language in Prop. A that some, including Kopp (now a retired judge) and the cab drivers union, argue could allow the Board of Supervisors and the Municipal Transportation Agency to abolish Prop. K.

Peskin says that was never the intent of his measure — and when we endorsed Prop. A, we took him at his word. It’s time for him to demonstrate that commitment. It shouldn’t be hard to meet with the United Taxicab Workers and figure out how to frame a trailer bill that would ensure that neither the supervisors nor the MTA can undo Prop. K. If the city attorney agrees that the board has the authority to enact that kind of legislation, Peskin should introduce it as quickly as possible. And if protecting the essence of Prop. K requires another charter amendment, this would be an excellent time for Peskin to start the process for the June 2008 election. 2

Ethics under attack

A group of political campaign treasurers who regularly handle the financial nuances of reporting election cash have signed a letter disparaging the operations of San Francisco’s Ethics Commission.

"Fewer and fewer of our members are willing to accept San Francisco local candidates and committees as clients because of the hostile environment that now exists," reads a July 23 missive addressed to the five Ethics commissioners and posted by the Los Angeles–based California Political Treasurers Association.

The letter includes a laundry list of gripes, including that Ethics staff treat treasurers like criminals; the audit, fines, and penalty processes are too slow; forfeitures of campaign donations for minor reporting errors are unfair; penalties for some infractions are unjust; there’s been no guidance on a new law banning donations from corporations; and that when screwups occur the paid, professional treasurers are treated more harshly than volunteers.

Twenty-one CPTA members signed the letter, and several echoed its contents at a Nov. 8 meeting with Ethics staff.

"Honestly, our firm will probably never touch a San Francisco ballot measure again," said Stacy Owens of Oakland’s Henry C. Levy and Co.

However, Ethics staff refuted some of those complaints.

For example, the treasurers universally decried the requirement that a donor have a street address as well as a post office box. "It’s stupid," said Kevin Henegen of the Sutton Law Firm, who did not sign the letter but did attend the Nov. 8 meeting.

But it’s a law throughout California, not just in San Francisco. "The state considers this very serious," said Oliver Luby, the fines collection officer of the Ethics Commission and the most outspoken staffer at the meeting. He pointed out that a street address can be used to verify the physical existence of a donor, while a PO box can easily shield a false identity.

Some of the treasurers said the quick pace of campaigning can turn the search for a simple street address into a battle, and the threat of a fine or forfeiture from the Ethics Commission causes them to consider not reporting the donation at all until after the election, when the address can be less hurriedly determined.

That’s a problem, according to Charles Marsteller, a good-government watchdog instrumental in the drafting of many of San Francisco’s campaign rules. He told us he’d like to see legislation that addresses the treasurers’ concerns while ensuring timely disclosure: "We don’t want to see a situation where two days before the election a large donation is not reported because the donor fails to disclose an address or occupation. This might give a handy excuse to justify not reporting things like large 11th-hour media buys."

The treasurers further complained that their being on the hook for a fine, fee, or forfeiture when a client screws up isn’t fair and that the past errors of a group shouldn’t affect how it’s treated in the future.

If a committee breaks the law and owes money, the treasurer is legally responsible, but these paid professionals could act as filers instead and leave the name of treasurer and any monetary penalties to one of the committee members, as Luby told us.

While the treasurers complained that forfeitures of donations for reporting errors are a penalty that no other California jurisdiction imposes, Luby said that San Francisco hasn’t enforced them since 2002.

He also penned a detailed 17-page memo responding to the CPTA’s complaints, which includes a matrix showing that most of the signers of the letter don’t do business in San Francisco and only 4 of the 21 have had to pay fines here since 2002.

While he argues that those four are disgruntled professionals who have tangled with Ethics in the past, he does not entirely dismiss the CPTA’s observations of serious management inconsistencies at Ethics. In particular, he cites the perception of unfairness when routine late fees and fines, which he handles, are wrapped up in campaign investigations — which are conducted, in secret, by another sector of Ethics and can result in different monetary penalties. Over the years the standards for fines have dissolved as secret deals have been cut to settle investigations.

"Since my arrival in 2002, my mantra for penalties has been consistency, consistency, consistency," Luby writes. "By routinely being a stickler for standards over the years, I have detected the Commission management prefers greater flexibility when regarding when to grant a waiver. In particular, waiver standards have been applied inconsistently when late fees and forfeitures are incorporated with investigative penalties."

The CPTA asked for a task force to fully vet solutions to some of Ethics’ problems, which Commissioner Emi Gusukuma said she’d be willing to join. "This is a great first step," she said of the Nov. 8 meeting, which she and Commissioner Jamienne Studley attended. "But it’s still a big, meaty issue."

John St. Croix, executive director of Ethics, said the agency will be taking these issues seriously. "There’s a lot of frustration because people don’t know what our processes are," he said. "If we are being unfair, we can normalize our processes."

This oil spill — and the next

EDITORIAL The first headline the San Francisco Chronicle ran after the Cosco Busan crashed into a Bay Bridge protective fender Nov. 7 implied that nothing terrible had happened. It read, almost comically, "CRUNCH!" Initial reports suggested that only a few hundred gallons of fuel oil had spilled from the gash in the 810-foot freighter’s hull. Caltrans assured the public that the system had worked: the fender had absorbed the blow, the bridge had suffered no damage, and motorists had no cause for concern.

It wasn’t until much later in the day that the public learned just how big an ecological disaster was unfolding in the bay. And the most disturbing evidence is only now becoming clear: this was an accident waiting to happen. The regulations and processes in place to prevent a catastrophic oil spill in the bay — where thousands of ships with tanks carrying foul and toxic fuel oil sail through a fragile ecosystem every year — were, and are, tragically inadequate.

Just look at the record so far:

The Coast Guard’s Vehicle Traffic Service on Yerba Buena Island, which has extensive radar and electronic tracking devices, was clearly aware that the container ship was heading for a collision — but was unable to stop it.

The fog was thick, and the ship, which had just made a wide S turn out of the Port of Oakland, was far from the center of the 1,200-foot-wide channel under the bridge. The Coast Guard could hardly have missed what was going on.

In fact, according to news reports, a VTS staffer radioed the bar pilot at the helm of the ship minutes before the crash and warned him that he was on an errant course. "Your [compass] heading is 235. What are your intentions?" the VTS staffer asked (essentially saying, in nautical-radio speak, "What the hell are you doing?"). The pilot, John Cota, insisted he was heading right for the center of the span and not to worry, his lawyer told reporters.

Imagine, for a moment, what would happen if air traffic controllers at San Francisco International Airport saw a commercial jet flying off course in zero-visibility fog and heading for the top of San Bruno Mountain. The controllers wouldn’t ask the captain what his intentions were; they would announce an imminent crash and order him to immediately increase altitude, change course … whatever was necessary. The captain wouldn’t argue that his or her instruments said everything was fine; the airliner would change course at once and sort out the question of instrument accuracy after it was out of harm’s way.

But traffic regulators on the bay operate under different rules. Even a minor course change would have prevented the accident — but according to VTS rules posted on the Web, the Coast Guard has no authority (other than in times of national-security alerts) to directly order preventative action. Under centuries-old rules of the sea, the captain of a ship is in total control and can’t be told what to do, even if a disaster is looming — and modern safety regulations haven’t caught up to that tradition.

The ship was sailing under terrible conditions, with almost zero visibility, and even some bay captains say running a 70,000-ton vessel in an area like this in fog that thick is a bad idea. But the shipping companies have so much money on the line that nobody wants to slow down the schedules.

It’s no secret where the fuel tanks are in a ship like this. The moment the ship took a gash that size in the hull, the authorities should have assumed that a sizable and extremely dangerous spill was in the works and begun immediate emergency containment procedures. But somehow just about everyone seemed to believe the initial reports that the crew of the ship had transferred the fuel away from the hole and only a trivial amount had escaped.

Remember, we’re talking about a rip of 100 feet, one-eighth the length of the ship, right in the part of the hull where half a million gallons of nasty bunker fuel were stored. Emergency responders should have known a spill was inevitable and gone into action right away.

Yet hours passed. No public warning was issued. Bay swimmers continued to take their morning natations — and some came back covered with oil. Nobody knew what was going on.

The day after the spill, when it was clear an ecological disaster was happening in the bay, San Francisco mayor Gavin Newsom split town and went on vacation.

So far, the taxpayers are picking up the tab for the cleanup — and in the end, it may prove difficult to get the owner of the ship to pay, even if faulty navigation equipment on the Cosco Busan was at least partly the cause of the spill. The companies that own these big ships use layers of dummy corporations, legal tricks, and secretive contracts to protect them from liability. In this case, the Chronicle has reported, the Cosco Busan is a Chinese vessel owned by either a company in Cyprus or one in Hong Kong and managed by a separate Hong Kong outfit. It’s going to take years to get to the bottom of who should pay for this mess.

Meanwhile, the crab-fishing industry is out of business, and the economic impact will be dramatic.

There are obvious lessons here — and the first is that the public and all of the regulatory and response agencies at every level of government have to stop taking a nonchalant, hands-off attitude toward the ships that represent an ecological time bomb in the bay.

Shipping is part of the lifeblood of the local economy, and everyone who lives in the Bay Area has to live with the fact that giant steel vessels loaded with toxic fluids are going to be passing through a diverse and easily damaged ecosystem every day of every year for the foreseeable future. But there’s a lot that can be done to make it safer.

For starters, the VTS ought to have the mandate and the authority to regulate shipping traffic in the same way that air traffic controllers regulate planes. Among other things, the service should keep ships in port when the fog is that thick and conditions aren’t safe. Sen. Dianne Feinstein is mad about the spill response, and that’s fine — but she and her Bay Area congressional colleagues ought to push for legislation that would allow the Coast Guard to ensure this doesn’t happen again.

There’s a desperate need for a bay spill early-warning system, something that could go into effect the moment there’s a possibility of oil fouling the water — and get containment crews on hand quickly and let the public know the hazards. That’s something the State Legislature should move on immediately.

Perhaps Congress should mandate that ships passing through US coastal waters post an accident bond to ensure they don’t escape liability for disasters. But for now, the federal government needs to seize the Cosco Busan, impound its cargo, and make it clear that nothing is going anywhere until the bill for this catastrophe is settled.

And the state and federal governments need to compensate the crab fishers — and then collect the money from the ship’s owners to cover those costs.

Money and politics

The upcoming election hasn’t generated much voter interest, with only a couple of measures that seem likely to have an impact. But corporate interests in San Francisco and beyond are still spending big money — in ways that are secretive, suspicious, and sometimes contradictory — to influence the election and win the gratitude of elected officials.

Although the final preelection campaign statements were due Oct. 25, the money continues to roll in. And perhaps most ominously, many campaign committees are spending far more than they are taking in, effectively using this accrued debt to hide contributors until after the election.

And almost invariably, the person at the center of such schemes — who facilitates the most creative and unsettling spending by downtown political interests — is notorious campaign finance attorney Jim Sutton, who also serves as Mayor Gavin Newsom’s treasurer (and didn’t return our calls for comment by press time).

Political donations are supposed to be transparent and reflect popular support for some campaign. But once again, this election is showing the disproportionate influence that corporations have on local politics and the difficulties faced in trying to accurately trace that influence.

There are "No on K" billboards all over San Francisco, showing a giant image of a man’s empty pocket alongside the dubious claim that "Proposition K will cut $20 million from Muni." The signs were created and funded by Clear Channel Outdoor.

Prop. K is an advisory measure that the Board of Supervisors placed on the ballot this fall to ask whether voters want to restrict advertising on public spaces like bus stops. But it was aimed at Clear Channel Outdoor’s contract to maintain 1,100 city bus shelters and sell advertising on them, which was approved by the Board of Supervisors on Oct. 23. In exchange, the CCO agreed to pay the Metropolitan Transportation Authority $5 million annually, plus 45 percent of its annual revenues from shelter ad revenues.

Nonetheless, the measure would put city voters on record as opposing the CCO’s basic business model, so the company fought back. The "No on K — Citizens to Protect Muni Services" filing suggests that there is no citizen involvement in the No on K campaign. So far, No on K has only received donations from Clear Channel Outdoor, including $120,000 in cash and $55,750 in in-kind contributions of radio time and ad space.

Maybe Clear Channel really is trying to help Muni get more money, rather than pad its own profits. After all, its parent corporation, Clear Channel International, donated $20,000 to support Muni reform measure Proposition A — authored by Board of Supervisors president Aaron Peskin — on Oct. 15, just days before Clear Channel Outdoor won its big bus transit deal with the city.

Yet following the corporate money even further makes it clear that altruism isn’t what motivates corporate spending. No on K also benefited from independent expenditures by the San Francisco Chamber of Commerce 21st Century Committee, a general-purpose committee created in 1999, which received major funding this year from the Gap ($10,000), Pacific Gas and Electric Co. ($7,500), Bechtel ($5,000), Catholic Healthcare West ($5,000), and Clear Channel Outdoor ($1,000).

The 21st Century Committee also spent $716 for newspaper ads opposing Prop. A, which would net the MTA at least $26 million per year from the city’s General Fund. Sutton — a former chair of the California Republican Party — and his associates effectively control the 21st Century Committee, which is also helping Newsom, his top client, avoid facing the Board of Supervisors in public. The committee has made independent expenditures opposing Proposition E, a charter amendment that would require the mayor to make monthly appearances before the board, something voters approved last year as an advisory measure. According to Newsom spokesperson Nathan Ballard, defeating that measure is the mayor’s top priority this election.

"I think he’s focused on his own race and also Question Time. There’s where he’s spending his resources," Ballard said when asked why Newsom isn’t campaigning or fundraising for the Yes on A and No on H campaigns, even though he supports those positions.

The 21st Century Committee has also made independent expenditures in support of Proposition C (which would require public hearings for measures that the board or the mayor places on the ballot), Proposition H (see "Transit or Traffic," page 18), Proposition I (which would establish an Office of Small Business), and Proposition J (Newsom’s wireless Internet advisory measure).

Each of these ballot measures has a committee dedicated to raising funds, but as of Oct. 25, only the Small Business Campaign (Yes on C) appeared to have no outstanding debts, or accrued funds, as they are called in campaign finance circles. Maybe that’s because the Small Business Campaign got $10,000 from the 21st Century Committee, $5,000 from PG&E, $2,500 from AT&T, $8,500 from the SF Small Business Advocates, and $1,000 from the Building Owners and Manufacturers Association of San Francisco’s political action committee.

Yes on C also got a $7,500 contribution from the Committee on Jobs Government Reform Fund, which has ties to Clear Channel, the MTA, and efforts to influence local transportation policy. Records show that on Nov. 4, 2005 — just before the election — the Committee on Jobs Government Reform Fund reported a $6,900 "loan" for radio airtime and production costs from Clear Channel to help defeat a measure that would have split the MTA appointments between the mayor and the Board of Supervisors.

Fast-forward to Oct. 3 of this year, when the Committee on Jobs, which reported its "loan" as accrued funds for almost two years, reported that this debt has now been forgiven. Which is odd, given that, as of Oct. 25, the Committee on Jobs had a cash balance of $778,000 — and had just received $35,000 from financier and Committee on Jobs board member Warren Hellman, $35,000 from AT&T, and $50,000 from the Charles Schwab Corp.

Equally interesting is the fact that the day after the Oct. 25 preelection filing deadline, the Committee on Jobs gave $25,000 to the Sutton-controlled No on E: Let’s Really Work Together Coalition. Such large late contributions require a notice to Ethics that can often escape notice by the media and voters.

The donation perhaps went to help balance the committee’s books; despite receiving $85,084 in monetary contributions, including $10,000 from attorney Joe Cotchett and society maven Dede Wilsey, No on E spent $110,244 before Oct. 25, leaving it with $26,610 in accrued debt.

No on E isn’t the only Sutton-controlled committee whose spending has outpaced donations received: as of Oct. 25 the Yes on H–No on A pro-parking committee and Newsom’s WiFi for All, Yes on J committee, not to mention the Gavin Newsom for Mayor campaign, were all registering large amounts of accrued debt.

Having these debts isn’t illegal. And it’s not unusual for a campaign to have a pile of unpaid bills at the time of its last preelection finance filing. But as Ethics Commission director John St. Croix told the Guardian, accrued funds "shouldn’t be used to hide who your contributors are. The idea of disclosure is to let voters know ahead of elections who is trying to influence their vote."

St. Croix points to the fact that committees are required to make reports every 24 hours in the 16 days before an election "so you know what they are spending on…. But if committees don’t report campaign contributions and people fundraise after the election, that could be a de facto way to hide who the contributors are."

And while Sutton has been characterized by many, including the Guardian (see "The Political Puppeteer," 2/2/04), as the dark prince of campaign finance, St. Croix says he doesn’t automatically suspect something is wrong just because a campaign has a lot of accrued debt.

"But if people suspect that to be the case and they file a complaint, Ethics investigates," St. Croix said, adding that for him, "really massive accrued funds would be a red flag."

Asked what he meant by massive, St. Croix said, "It depends on the office. You might expect a lot more to accrue in a mayor’s race or large campaigns that tend to do a lot of last-minute spending."

As of Oct. 25, Gavin Newsom for Mayor had received $1.1 million and spent $1.3 million, had a cash balance of $457,994 — and was reporting $97,548 in accrued debt, with $46,500 owed to Storefront Political Media, the company run by Newsom’s campaign manager, Eric Jaye.

Noting that Ethics’ job is "to get people to file on time and chase after those who don’t," St. Croix said that those who don’t file and are making major expenditures right before an election are the ones who will face the biggest fines. "They could face $5,000 per violation, which could be $5,000 for every contribution that was made to finance a smear campaign and wasn’t reported," he said.

The biggest fine the Ethics Commission has ever issued was $100,000 for Sutton’s failure to report until after the 2002 election a late $800,000 contribution from PG&E to help defeat a public power measure.

Compared to other years, the amounts of accrued debt in this election may look small, but former Ethics commissioner Joe Lynn points to a disturbing pattern in which Sutton-controlled committees were insolvent before the election, then raised funds later or, as in the case of the Committee on Jobs, magically saw their debts forgiven.

"If I am a candidate running for mayor, like Gavin Newsom, and I personally rake up $100,000 in debt and have a big financial statement, then that means there’s a creditor willing to advance me those funds," Lynn said. "But if the debt has been raked up by a ballot measure committee, then who is responsible? Why would vendors spend $10,000 for that committee unless they knew that debt was wired from the get-go?"

But the result is the same: voters don’t know who donated to the campaign until after the votes have been cast. A clear historical example of this debt scheme can be seen in the June 2006 No on D Laguna Honda campaign. In its last preelection report, No on D had $59,750 in contributions, $18,664 in expenditures — and $130,224 in debt.

But during the 16 days before the election, No on D suddenly got $110,000 in late contributions from the usual suspects downtown, including $2,500 from Hellman, $15,000 from Turner Construction, $10,000 from Wilsey, $2,000 from the San Francisco Chamber of Commerce, and $2,500 from the Building Owners and Manufacturers Association of San Francisco.

As Lynn explains, campaign finance laws only require disclosure of contributions, not expenditures, made in the 16 days before an election — and only $64,000 worth of the contributions used to pay off No on D’s accrued expenses were disclosed, with $10,000 each from the California Pacific Medical Center and Kaiser Permanente trickling in on or after Election Day.

This year campaign finance watchdogs like Lynn note that the Sutton-controlled Yes on H–No on A committee has been hiding its contributors. In its first preelection report, filed Sept. 22, Yes on H showed $113,750 in contributions, $111,376.18 in expenditures, and $69,806.98 in accrued debt.

A month later it has doubled its contributions, tripled its expenditures — and had increased its accrued debt to $77,509. Lynn predicts that Yes on H’s accrued debt will be paid down by late contributions after the election or forgiven later on.

"The solution to the debt scheme is twofold," Lynn said. "Prosecute people doing the scheme and pass a law prohibiting campaigns from making more expenditures than they have contributions. Technically there is nothing illegal about reporting more debt that you have the cash or contributions to pay, but no businessperson regularly offers services in situations where it isn’t clear that they will be paid."

Since the Oct. 25 filing deadline, late contributions have continued to pour into No on E big-time, for a total of $59,500. That includes $25,000 from the Committee on Jobs, $2,500 from Jonathan Holzman, $6,000 from Elaine Tsakopoulos-Kounalakis, $1,000 from Chris Giouzelis, $1,000 from Nick Kontos, $1,000 from Farrah Makras, $1,000 from Victor Makras, $1,000 from Makras Real Estate, $5,000 from John Pakrais, $1,000 from Mike Silva, $1,000 from Western Apartments, $5,000 from Maurice Kanbar, and $5,000 from the San Francisco Apartment Association PAC.

The Yes on A committee hasn’t used the accrued debt scheme, but it has been the second-largest recipient of late contributions. It received $57,000 in late contributions, with donations from Engeo ($1,000), Singer Associates ($2,500), Trinity Management Services ($10,000), Elysian Hotels and Resorts ($5,000), Luxor Cabs ($1,000), Marriott International ($15,000), the SF Police Officers Association ($2,000), Sprinkler Fitters and Apprentices ($1,500), Barbary Coast Consulting ($2,500), and SEIU International ($3,397.14).

No on H (Neighbors Against Traffic and Pollution) received $4,500 in late contributions, with donations from Norcal Carpenters, Alice and William Russell-Shapiro, and Amandeep Jawa. And in what looks like a classic case of hedging bets, Singer Associates has made a $2,500 late contribution to both Yes on H and No on H.

Steven Mele, who is treasurer for Yes on A and No on H, told the Guardian, "There’s some people that time their contributions, but their names are out there, reported on public sites. A lot of corporate money comes in prior to the last deadline, then some afterwards. If campaigns are running with a lot of accrued debt, then those people must have an idea of what money is going to come in."

Unlike the campaigns controlled by the Sutton Law Firm, Mele’s committees, which work with Stearns Consulting, are not carrying massive loads of unpaid debt. Yes on A had received $302,452 and spent $279,890 and had $17,749 in debt as of Oct. 25. No on H had received $134,458 and spent $124,088 and had no debt as of Oct. 25.
Mele also believes that while campaign finance rules were written to make the money trail more transparent, "They’ve resulted in the public being inundated with so much information that they tend to glaze over."

Campaign sewer overflows

The flow of election cash is often a filthy river that you wouldn’t want to drink from, and a recent local lawsuit, coupled with a new bit of state legislation, has muddied the waters even more.

On Sept. 20, US District Court Judge Jeffery S. White granted a preliminary injunction preventing the city from enforcing key sections of its Campaign Finance Reform Ordinance.

Two local groups with a sordid history of influencing elections with large chunks of cash — the Building Owners and Managers Association and the Committee on Jobs — argued in court that campaign contribution limits violate the First Amendment by financially curbing the ability to communicate a message (see "Pressing the Scales," 8/22/07). The contribution limits of independent-expenditure committees stumping for candidates were set by the voter-passed Proposition O in 2000 after the 1999 reelection of Mayor Willie Brown, in which deep-pocketed business interests backed the mayor in exchange for preferential treatment by city hall.

Prop. O capped contributions to IEs at $500, and people and corporations are allowed to give no more than $3,000 total (e.g., $500 each to six committees).

Those caps are no longer enforceable.

Similar injunctions have been granted in San Jose and Oakland, also destroying local contribution caps in those cities. San Jose appealed to the 9th Circuit Court of Appeals and is waiting for a ruling. Ann O’Leary, a lawyer in City Attorney Dennis Herrera’s office, told us San Francisco is waiting to see what happens in San Jose before making the next move, though an appeal is planned regardless of that outcome. In the past the Supreme Court has ruled that the appearance of corruption in elections is sufficient grounds for restricting campaign contributions, and San Francisco’s history provides ample examples from which to draw to support that decision.

"We don’t know if it will get back to court before November 2008," O’Leary said of the case, "but it’s certainly something to watch in that election."

Meanwhile, over in Sacramento, legislators on cruise control recently passed a bill that may make it impossible for San Francisco to write its election laws anyway. Gov. Arnold Schwarzenegger just signed Assembly Bill 1430, and according to the legislative digest, the new law "prohibits local governments from adopting campaign finance ordinances that restrict communications between an organization and its members unless state law similarly restricts such communications, or by regulation by the Fair Political Practices Commission."

Proponents say the new law will resolve conflicting interpretations of campaign finance regulations, but opponents say it preserves wide-open loopholes in the Political Reform Act that local jurisdictions have tried to close. For example, a person may be prohibited by the city from giving more than $500 to support a certain candidate. That person can, however, give as much as $30,200 to the Democratic Party, which can then "communicate" a message of support for that candidate to its members.

A recent and egregious example: in San Diego the county Republican Party spent almost $1 million on local races in 2006.

The bill was authored by Carlsbad Republican Martin Garrick and flew through the State Assembly unopposed. Assemblymember Mark Leno told us it came to the Elections Committee, on which he sits, with no vocal opposition, so he gave it an aye. One of his aides, however, became concerned and started making calls. Eventually, Common Cause and the League of Women Voters rallied against it, but it only hit a speed bump in the State Senate. There was still too much support from the Democrats to kill it. Leno said, "It’s an uncommon situation to have the left and right supporting something that in fact runs counter to local election laws."

Only nine senators opposed the bill, including Carole Migden and Leland Yee. "She thought it was an end around campaign finance laws," Migden aide Eric Potashner told us.

San Francisco’s Ethics Commission also took a look at the bill and gave it a 5–0 thumbs-down, resolving to send a letter to both the mayor and the Board of Supervisors urging them to speak against it. Neither did. "The Mayor supports AB1430," his press secretary, Nathan Ballard, told us by e-mail. "He has some concerns about the local control issue, but ultimately those concerns are overridden by his belief that groups like labor unions and the Democratic Party should be allowed to communicate directly with their members."

The governor’s signature now makes it more difficult to pass future measures like Prop O.

Neither the injunction nor the new law seems to be affecting the Nov. 6 election — the FPPC won’t be ruling on AB 1430 until January, though the commission is holding a hearing for interested people to speak in Sacramento on Nov. 2.

Though BOMA and the Committee on Jobs stated in their filing for the injunction that the law harms their ability to raise and spend money for candidates in this November’s election, nothing on record with the Ethics Commission shows they’ve been putting up a lot of money for Newsom, Kamala Harris, or Michael Hennessey. But there’s always next year.

Gavin Newsom will never live down his drunken affair with a close friend’s wife. It’s not a factor in this year’s mayoral race (which shows that San Francisco still has some class), but it’ll come back to haunt him someday, when he runs for governor or senator or wherever he goes next. Bill Clinton’s got the same curse — for all the good and bad things he did as president and everything he’s done since and will do, when he dies the world’s most famous blow job will be in the first paragraph of his obituary. Dumb stuff never goes away.

On the other hand, Clear Channel Communications is one of the most evil corporations in the United States, a sleazy outfit that is trying to destroy radio here and has gone a long way toward monopolizing the industry. Clear Channel treats its workers badly and is notoriously antiunion. It’s the worst sort of unaccountable conglomerate — many of its radio stations operate on remote control, with virtually no local staff, and it’s almost impossible to get through to anyone at corporate headquarters in San Antonio. Lowry Mays, its chairperson, is a big contributor to the Republican Party and to right-wing causes.

And yet none of that stopped the Board of Supervisors from giving Clear Channel tentative approval for a lucrative contract to build and sell ads on bus shelters in San Francisco. The whole thing annoyed me. If there’s so much money in bus shelters, why can’t the city build them and sell the ads and make some cash for the General Fund? But that aside, I have to ask: Why are we doing business with these people? Shouldn’t corporations, which want to be treated legally the same as individuals, be held accountable for their actions and their history?

At least Sup. Tom Ammiano brought up some of Clear Channel’s record. Some labor leaders tried to scuttle the deal. But the bus drivers’ union really wanted the contract approved, because Clear Channel will dump a bunch of money into Muni, so it went through, 9–1, with only Sup. Ross Mirkarimi opposed (and Sup. Chris Daly absent).

Then there’s Sutter Health.

On Saturday, Oct. 20, when nobody read the newspaper, the San Francisco Chronicle reported that Sutter is going to effectively shut down St. Luke’s Hospital in the Mission by turning it into an ambulatory clinic with an emergency room. No hospital beds, no place to put very sick people, nothing resembling the sort of service the district has counted on for decades. Instead, Sutter — which is allegedly a nonprofit but acts like a rapacious and greedy corporation — is going to stick San Francisco General with all of the uninsured sick people in the southeast neighborhoods while it gussies up its properties in the wealthier northern part of town.

The nurses have had to go on strike to demand better care for patients at Sutter. Even Mitch Katz, the city’s public health director, who is not known for blasting the private sector, has complained loudly that Sutter is doing a disservice to San Francisco.

And while all of this is going on, this allegedly nonprofit behemoth wants to build a $1.7 billion, 425-bed hospital at the old Cathedral Hill Hotel site at Van Ness and Geary.

Sutter only likes sick people who have good health insurance or are rich enough to pay cash. Perhaps the supervisors can remember that and hold these assholes accountable when they come to City Hall for a building permit.

Airlines demand corporate welfare

The major airlines that serve the Bay Area, with the help of the Hotel Council of San Francisco, are trying to get out of paying millions of dollars in taxes to the city by claiming the right to use a law that was designed to help San Francisco’s poorest residents. And they’re threatening to prevent their employees from staying in the city if the Board of Supervisors doesn’t acquiesce to the corporate welfare demand.

At issue is the city’s 14 percent Transient Occupancy Tax, which is paid by hotel guests. It is the third-largest source of local tax revenue, after property taxes and payroll taxes, bringing in $177 million in the last fiscal year. The only major exemption from the tax is for permanent hotel residents, generally those on the brink of homelessness who live in the run-down single-room-occupancy hotels for months or even years on end.

Major airlines house hundreds of their employees in San Francisco’s hotels each night. They are arguing that because of past court rulings on corporate personhood — in which judges have deemed that corporations have the same rights as individuals — the airlines should be exempt from paying the tax when they rent blocks of rooms for their employees.

The airlines, in collusion with some hotels in the city, have long used the exemption to avoid paying taxes on many of the rooms they rent (about two-thirds, according to the Hotel Council, which translates into millions in lost city revenue every year). A few years ago city officials told the corporations that the exemption didn’t apply to them and that they should be paying the tax.

Enacted in 1960, the Permanent Resident Exclusion exempts from the tax individuals who occupy or have the right to occupy the same hotel room for at least 30 consecutive days. “We looked at the legislative history, and it was clearly put there to help formerly homeless people,” Treasurer José Cisneros told the Guardian. “The city has always said that 30 consecutive one-night stays are not the same as a 30-night stay by an individual.”

The hotels and airlines challenged that interpretation and had their case thrown out of court. So now they’ve turned to the Board of Supervisors in the hope that they can win this chunk of corporate welfare by using threats of an economic exodus.

 

CORPORATE SHAKEDOWN

In October 2004, American Airlines and the San Francisco Hilton filed a lawsuit against the city arguing that airline crew members staying in San Francisco hotels qualified for an exemption from the hotel tax. The lawsuit was dismissed in May 2006 without going to trial, with Superior Court Judge James Warren ruling that the plaintiffs “did not assert and did not present any evidence that any particular room at the Hilton was continuously registered to American Airlines for more than 30 days.”

To clarify any ambiguity in the law, Cisneros in May issued an interpretation stating, “Although an agreement between a person and a hotel may require that the person pay the hotel for a minimum number of ‘guaranteed’ daily reservations for the person’s employees over a period of time longer than 30 days, such an agreement does not create any permanent resident exemption for any guest rooms unless the above criteria are satisfied,” referring to criteria that include “a person is a registered hotel guest” and “that person or any of that person’s employees continuously occupy or have the right to occupy the same room for 30 days or more.”

Yet now, at the request of Sup. Michela Alioto-Pier, the Board of Supervisors’ Government Oversight and Auditing Committee has scheduled a Nov. 19 hearing for the purpose of “explor[ing] the unintended consequences of this decision, including the loss of revenue to the City when the airlines inevitably move their crews to another location in the Bay Area where room rates are more competitive.”

That implied threat comes from Hotel Council executive director Patricia Breslin, who paints a doomsday scenario if the airlines have to pay the hotel tax on every room they rent. Breslin warns that if the Board of Supervisors does not offer concessions to the airline industry, it could bring about an “economic tsunami” that would hit hotels, restaurants, and city government.

Airline employees occupy an average of 1,050 hotel rooms per night in San Francisco, according to Smith Travel Research, an information and data provider for the lodging industry. Given that the tax is collected by the hotels, Cisneros doesn’t have data on how much the airlines should be paying the city. But assuming the airlines negotiate rates of about $100 per night, that would translate into more than $5 million per year.

“We pushed so hard to get them to pay it that they sued us,” Cisneros told us.

Breslin said the airlines have been paying about $1.7 million per year in hotel taxes and that sales taxes generated by airline employees bring another $1.4 million into the city, all money that would be lost if the airlines go elsewhere. She said the airlines have threatened to begin putting their employees in hotels in Peninsula cities near the airport, like Burlingame, San Mateo, and even San Jose, to cut costs. Already Mexicana Airlines has stopped using San Francisco’s hotels for its employees. Other airlines, such as Virgin Atlantic, United, Cathay Pacific, and Lufthansa, have threatened to follow suit.

Breslin said hotels would be forced to lay off cleaners, servers, and other low-income workers due to the loss of business that would accompany the exodus of airline employees. San Francisco, she argues, would “lose a significant revenue stream” if the airlines lose their appeal.

“It will change the economics of San Francisco,” she told us. “This is not a frivolous issue.”

 

CALLING THEIR BLUFF

Granting the exemption would cost the city millions of dollars, but that isn’t the only reason being offered for opposing the gambit. Some city officials simply don’t believe the airlines — or their employees, most of whom are union members, many of whom have contracts specifying their accommodations be in urban centers — will abandon San Francisco.

Sup. Chris Daly, who is on the Oversight and Auditing Committee, is against granting the exemption to the airlines. “They blow smoke all the time,” he told us, referring to major industries such as the hotel and airline industries. “That’s how they get away with not paying taxes.”

Cisneros argues the airlines’ threat to move their employees into suburban hotels isn’t logical, noting that San Francisco hotel rooms are already far more expensive than their suburban counterparts — with or without the hotel tax — and the airlines have always chosen to keep their employees here anyway.

“I just don’t think the threat is realistic at all,” Cisneros said. “If they were basing their decision on which hotels are cheapest, they would have never been staying in San Francisco.”

Recently compiled data and trends in tourism and hotel occupancy rates also suggest that Breslin’s warning of a crippling economic backlash are unfounded. According to an August article in the San Francisco Business Times by Ryan Tate, “Next year promises to be by far the most robust for leisure and business travel in San Francisco since the dot-com boom.”

He continues, “Convention business will reach more than 900,000 hotel rooms in 2008, well above the 740,000 room nights booked by conventions in 2007.” The San Francisco Convention and Visitors Bureau forecasts that overall tourism will top 16 million visitors next year and that visitor spending will exceed last year’s record $7.8 billion.

The taxes the city collects from hotels go toward funding a wide range of public services. Some of the money is earmarked for the Convention and Visitors Bureau and for maintaining convention facilities. Some funds are allocated for low-income housing and rent supplements. The War Memorial Department, the Asian Art Museum, and the Arts Commission all receive funding through the hotel tax as well, with excess dollars poured into the city’s General Fund.

San Francisco’s tourism industry is the city’s largest industry and its second-largest employer, after the city and county government. “You want to make sure your number one industry is protected,” Breslin told us.

Yet the policy that she’s asking the city to enact runs counter to the policies in other major cities, including those thought to be less politically progressive than San Francisco. In Los Angeles, for example, only individuals can be granted exemptions from paying the hotel tax. In Chicago the exemption is even stricter and only applies to people who use hotel rooms as their domicile.

41st Anniversary Special: Psych out

San Francisco is a beautiful place. But it’s also a city where an extraordinary number of people suffer from mental health problems, sometimes quietly, sometimes visibly. City government has always taken on the burden of caring for those who really need it, but the Gavin Newsom administration has been trying to outsource that obligation in recent years.

Department of Public Health director Mitch Katz has tried for years to trim the number of psychiatric-care beds maintained by San Francisco General Hospital. He proposes to replace those services by contracting them out to local nonprofit Progress Foundation, which earned most of its $11.5 million in revenue last year from government sources.

The proposal is for Progress to develop and operate a community-based psychiatric treatment center as an alternative to SF General’s emergency-room and inpatient beds. A key difference would be that the alternative treatment would be voluntary and cater to those without severe symptoms.

Katz wants to eliminate 14 of SF General’s beds and reduce the number of patients it assesses by 30 percent. Add to that seven other beds that were stripped of funding two years ago, and it’s clear that mental health treatment in San Francisco is changing.

"It’s a problem we have to solve by coming up with alternatives," Katz told the board’s budget committee Oct. 10, "because it’s not right for that person, or for the cost to the system, that [they] be in a locked ward. It’s more downstream alternatives."

Opponents of the cuts, however, including psych nurses at SF General, led by the hospital’s chief of psychiatry, say the Progress proposal might complement SF General’s services but it would be dangerously shortsighted to think it can replace them.

Private-sector hospitals in San Francisco have already cut a combined 100 psych beds over the past 10 years, leaving behind only 75. Patients relying on Medi-Cal subsidies end up at SF General more than ever. Admissions, in fact, have climbed by as much as 50 percent in the past decade.

"I don’t want to be alarmist," said Alfredo Mireles, a psychiatric nurse at SF General who is opposing the cuts, "but we have this one guy who’s been in and out of here since his teens. He’s in his 30s now. He’s smart, college educated. But he has these violent outbursts with no remorse."

The man had assaulted a police officer just the night before, Mireles said. He recalled another patient who was so paranoid he wouldn’t come out of his room to eat. He had ended up in the emergency room after not eating for eight days.

Nonetheless, SF General’s psych ward maxed out last December for the first time in its history, forcing police offers to divert patients to jail or to hospitals unprepared to deal with them. All those facilities can do is strap down the patients or lock them in seclusion until a slot opens at SF General.

"You have to be very acute to get admitted," psych nurse Stacey Murphy said, referring to SF General. "But then we can’t get rid of people, because nobody wants them. They’re not acute enough to technically belong in our hospital, but they belong in a locked facility or in board and care."

Murphy explained that Progress won’t be able to handle certain patients now living in a sort of gray area at SF General — between being willingly and unwillingly hospitalized — such as the drug addled or violent. And that’s one problem with privatization in general: corporations and nonprofits will gladly take over profitable services, but the hard or expensive cases often fall to government … or simply through the cracks.

Progress argues that SF General spends too much time and money on patients who have serious mental health problems but aren’t so acute that they need to be locked up. Its idea is to put psych patients back into the city but help alleviate the misery they might otherwise endure alone or in a maddeningly sterile hospital. It seems to think the hard cases aren’t that hard.

"The time and resources devoted to this group of clients in a psychiatric crisis who are not hospitalized represents a cost to the mental health system that is unnecessary and avoidable if the intervention, triage, assessment, and treatment can occur in a community setting," the Progress Foundation’s June proposal reads.

"To the extent that there are people who would do better if we really wrapped services around them, shouldn’t we all focus on those people who would accept services voluntarily?" Katz asked the committee. "I think to focus a lot of our resources trying to convince people to take treatment against their will as outpatients when so many people would benefit from more loving, positive care, I don’t think it’s the right priority."

Piers Mackenzie still views Katz’s plan as poor public policy. His daughter, then 22, required a brief stay at SF General’s psych ward during a sudden mental health catastrophe four years ago. The event politicized Mackenzie, and he has since agitated against attempts by Katz to scale back psychiatric services at the hospital.

"I couldn’t think of a more retrogressive step, simple as that," Mackenzie said. "When there’s a proven need for more beds than there are presently, to cut them is just plain idiotic. I don’t understand it."

Over the past few weeks almost every major news outlet in the country has reported on Blackwater, a private company the US government hired to do work in Iraq that was once the exclusive province of soldiers.

The deal hasn’t gone so well: on Sept. 16, Blackwater guards opened fire and, according to the Iraqi government, shot 25 civilians. The incident set off an international furor and has brought into focus the breadth of the company’s work for the US government. It’s prompted an investigation by the House Committee on Oversight and Government Reform, which showed that since 2001, Blackwater’s federal contracts have increased 80,000 percent. It’s revealed the massive pay inequalities between private security guards and US soldiers — the cost of one private guard could pay the salaries of six soldiers.

And it’s raised a question that’s critical to understanding how government increasingly works in the United States: should a private company be doing the work of the military?

Privatization of public services is all the rage in this country now, at all levels of government, from Washington DC to San Francisco. Supporters say the private sector can often work better and more efficiently than the old, bureaucratic, much-maligned government.

But Blackwater is a great example of the perils of privatization. And there are many more.

STARVE THE BEAST


Over the past few decades governments at all levels in this country have been in a near-perpetual state of deficit. Taxes are way down from their historic post–World War II levels, and except for a brief period during the tech boom, there is rarely enough money for even basic social services.

"It’s been a strategy since the ’70s to, as Grover Norquist calls it, ‘starve the beast,’<0x2009>" Robert Haaland, an organizer with Service Employees International Union Local 1021, told us.

And because politicians, even Democrats, are terrified of tax hikes, they’ve been looking for more efficient ways to use the money they have. The magic bullet goes by many names — privatization, public-private partnerships, competitive outsourcing, creative financing solutions — but the basic idea is to allow the power of competition, set free in an unregulated market, to provide the public with the best services at the lowest cost.

"To do or to buy is the question that all governments face," says Ken Jacobs, director of UC Berkeley’s Labor Center.

We’ve been buying. Since 2000, outsourcing of federal dollars has increased 100 percent, to $422 billion in taxpayer funds in 2006, according to a September study by the Washington DC US Public Interest Research Group. The US government is now the private sector’s largest customer.

San Francisco may be known as one of the most progressive cities in the country, but this town has also been wooed by public-private partnerships with promises of improvements to the golf courses, construction of a new power plant, and funding for the many civic needs we have.

PRIVATIZE MUNI?


Cheerleaders for privatization look at someone like Nathaniel Ford, executive director of San Francisco’s Metropolitan Transit Authority, and see everything that’s wrong with the public sector. Ford’s salary is nearly $300,000, plenty high enough to attract a talented leader. But the Muni system he runs keeps the average San Franciscan waiting on the corner in the morning, delivers that person to work at an unpredictable hour, and lurches them homeward every night aboard a standing-room-only bus. Nobody thinks Muni is performing well.

That makes the case for privatization seem almost appealing.

"The public has been schooled to think that government is the problem, not the solution," Elliott Sclar, professor of economics at Columbia University, told us. In his 2000 book on privatization, You Don’t Always Get What You Pay For: The Economics of Privatization (Cornell University), he writes, "American folk wisdom holds that, by and large, public service is uncaring, unbending, bureaucratic, and expensive, whereas competitively supplied private services such as FedEx are efficient and responsive."

Competition, the privatizers say, drives innovation. Less red tape means more efficiency. A lack of unions and collective bargaining agreements translates to lower labor costs. Large-scale multinational operations can reduce redundancy and streamline their processes — all of which adds up to a lean-running machine.

But this country has a lot of experience with privatization, and the record isn’t good.

One hundred years ago private companies did a lot of what we now call government work. "Contracting out was the way American cities carried out their governmental business ever since they grew beyond their small village beginnings," writes Moshe Adler, a Columbia professor of economics, in his 1999 paper The Origins of Governmental Production: Cleaning the Streets of New York by Contract During the 19th Century. At one time private companies provided firefighting, trash collection, and water supplies, to name just a few essential services.

But according to Adler, "By the end of the 19th century contracting out was a mature system that was already as good as it could possibly be. And it was precisely then that governmental production came to America. The realization that every possible improvement to contracting out had been tried led city after city to declare its failure."

For example, the 1906 earthquake and subsequent fires in San Francisco were what prodded the city to municipalize water service after the company charged with the task, Spring Valley Water, failed to deliver while the fires raged.

In Philadelphia as well as San Francisco, the business of firefighting was once very lucrative — for both the firefighting companies and the arsonists who were paid to set fires for the former to fight. And corruption was rampant. "Large amounts of public contracting out historically created lots of opportunities for fraud and nepotism," Jacobs said.

So public agencies stepped in to provide basic services as cheaply and uniformly as possible. Towns and cities took on the tasks of security with police and firefighting, education with schools and libraries, and sanitation with trash collection and wastewater treatment. Nationally, the federal government improved roads and transit, enacted Social Security benefits, and established a National Park System, among many other things.

And then, about 30 years ago, the pendulum started to swing the other way. Driven by University of Chicago economist Milton Friedman, enacted in a massive policy shift by Ronald Reagan, proliferated by Grover Norquist and the neocon agenda, and fully appreciated by corporations and private companies, privatization came back.

In Reagan’s first term, he cut taxes 25 percent overall; the rich got a 40 percent cut. Domestic spending fell by half a trillion dollars in the 1980s, although any savings were countered by a rise in the defense budget.

Harvard economist Lawrence Summers, quoted in Looking Back on the Reagan Presidency (Johns Hopkins University), put it this way: "The Reagan budgets will influence the government for the rest of this century. Just as the Great Society left an imprint of Federal commitment to help the indigent and equality of opportunity, the Reagan budget deficits will leave an imprint of non-involvement."

Such a massive realignment of money coupled with tax breaks too politically painful to reinstate led to a boom in the outsourcing of public services. Private companies began doing more municipal work, while nonprofit organizations tried to fill the gaps in funding for social services, welfare, housing, health care, and the environment.

The George W. Bush era has seen even more overt outsourcing. These days no-bid contracts are preferred, and at times government services are completely turned over to the private sector in "direct conversions," and the public agency that once did the job is not allowed to compete to keep it. The Washington Post recently reported that no-bid government contracts have tripled in the past six years.

This doesn’t really sound like the competitive free market espoused by the theory of privatization.

FLUNKING THE TEST


To field-test the primacy of privatization, the Reagan administration sponsored a transportation experiment in the early ’80s: Miami’s Metro-Dade Transit Agency got to compete against Greyhound. The two providers were each given five comparable transit routes to manage over three years, and 80 new buses were bought with a $7.5 million grant from the federal government.

After 18 months 30 of the Greyhound buses were so badly damaged that they had to be permanently pulled from service. Passenger complaints on the Greyhound line were up 100 percent, and ridership was down 31 percent over the course of a year.

Why? There was no incentive in Greyhound’s contract to maintain the equipment or retain riders. The company’s only goal was to deliver the cheapest service possible.

The Miami transit contract could have contained clauses calling for regular inspections or guaranteed ridership, but that would have significantly increased the cost of the work — perhaps to the point where it would have been competitive with what the city provided.

That’s an important lesson in privatization politics: when you add the cost of adequately protecting the public’s interest and monitoring contract compliance, the private sector doesn’t look so efficient.

Which is why many say privatization only succeeds as a theory — and why, for all the problems with Muni, no private company is likely to be able to do a better job.

"Market fundamentalists present an idealized, simpleminded notion of competitive markets in which buyers and sellers have equal knowledge," Sclar told us. "Anyone can be a buyer, anyone can be a seller, everyone can evaluate the quality of the good. In this never-never land, that’s often the way the case is made for privatization by this particular group of economists."

In the real world a number of issues arise when a service goes private. "Accountability gets to be a really big problem," Ellen Dannin, professor of law at Penn State University, said in an interview. "There are predictions about how much money will get saved through privatization, but no one ever goes back to check."

The September study by the US Public Interest Research Group profiled several companies that do government work, including Bank of America, LexisNexis, ChoicePoint, KBR (formerly Kellogg, Brown, and Root), General Electric, and Raytheon, and found instances of illegal behavior in all cases. There were often massive errors in the companies’ work.

Bank of America and LexisNexis had security breaches compromising the data of at least 1.5 million customers they were handling for the government. ChoicePoint allowed identity-theft scams amounting to more than $1 million in fraud. KBR overcharged the government millions of dollars for work in Iraq and Kuwait. GE made defective helicopter blades for the US military. Raytheon failed to fully test the systems of new aircraft. These companies are all still employed by the government.

When companies take over services that aren’t typically part of a competitive market, all sorts of unexpected problems occur. Jacobs points to the rash of contracting for busing services in cash-strapped school districts. Not only did costs eventually rise in many places, but when schools tried to go back to providing their own service, the skilled drivers who knew the routes, knew the kids, and were able to do much more than drive a bus were gone.

Sclar and Dannin agree that any service that lacks competition should be public. Sclar presented the example of electricity. "It’s a natural monopoly," he said. "Essentially it’s either going to be a well-regulated industry or it’s got to be done publicly."

Corporations exist to make money. And although graft, mismanagement, and scandal have always been present in City Halls around the country, in the end the legislative, judicial, and executive branches were not designed to generate profits. That alone means contracting out is financially dubious.

Hiring mercenaries is a classic example. "It costs the US government a lot more to hire contract employees as security guards in Iraq than to use American troops," Walter Pincus wrote in an Oct. 1 article in the Washington Post. "It comes down to the simple business equation of every transaction requiring a profit."

As Pincus details one of the many contracts between the security firm and the US, "Blackwater was a subcontractor to Regency, which was a subcontractor to another company, ESS, which was a subcontractor to Halliburton’s KBR subsidiary, the prime contractor for the Pentagon — and each company along the way was in the business to make a profit."

Blackwater charged Regency between $815 and $1,075 per day per security operative. Regency turned around and charged ESS a slightly higher average of $1,100. After that, the costs dissolve into the enormous bill that KBR regularly hands the federal government.

When the US Army is paying the bill the costs are far lower. An unmarried sergeant earns less than $100 a day. If you’re married, it’s less than $200. If you’re Gen. David H. Petraeus, it’s about $500 — less than Blackwater’s lowest-paid workers.

Very little about the Blackwater contracts would be known by anyone outside the company if it weren’t for the federal investigation, since private businesses are not subject to the same public-records laws as the federal government. They don’t have to open their books or publicize the details of their bids and contracts, and they often fiercely lobby against any regulations requiring this, which leaves the door wide open for corruption — which is what brought sunshine laws to government in the first place.

Sclar said that when it’s a good call to contract out, corporations, private companies, and nonprofits should be required to abide by public-records laws in addition to adhering to a five-year wait for employees departing the public sector for the private. "I think transparency should always be the goal," he said. "As much information as possible." If a company doesn’t want to make its records public, he told us, "[it shouldn’t] go after public work."

THE AIDS LESSON


Privatization comes in many forms and emerges for what often seem like good reasons.

In the early 1980s gay men in San Francisco were starting to get sick and die in large numbers — and the federal government didn’t care. There was no government agency addressing the AIDS crisis and almost no government funding. So the community came together and created a network of nonprofits that funded services, education, and research.

"The AIDS Foundation was founded in response to the epidemic at a time when there wasn’t a response from the federal government," Jeff Sheehy of the AIDS Research Center at UC San Francisco told us.

At first, activists all over the country praised the San Francisco model of AIDS services. Over time the nonprofits began to get government grants and contracts. But by the 1990s some realized that the nonprofit network was utterly lacking in public accountability. The same activists who had helped create the network had to struggle to get the organizations to hold public meetings, make records public, and answer community concerns.

That, Sheehy said, shouldn’t have come as a surprise.

"There isn’t that same degree of accountability that you would have" with the public sector, he told us. "SF General is not going to turn you away at the emergency room, but nonprofit hospitals are less and less interested in running ERs."

Sheehy said he’s seen cases where difficult clients have been banned from accessing help from nonprofits. Unlike at public institutions, "the burden is not on the agency to provide the service. It is with the client to get along with the agency," he said.

Sheehy outlines other issues: nonprofits run lean and are more apt to make cuts and resist unionization, which means workers are often paid less, there can be higher turnover, and upper management is often tasked with fundraising and grant writing and distanced from the fundamental work of the group. There’s no access to records or board meetings. "If service takes a sudden downward shift, what can you do?" Sheehy asks. "You can’t go to board meetings. You can’t access records. What’s your redress?"

And that perpetuates the problem of government not stepping up to the plate. More than half of the social services in San Francisco are run by nonprofits, a trend that isn’t abating.

"When the services are shifted from the public sector to the nonprofit sector," Sheehy said, "that capacity is lost forever from government."

THE LOTTERY TICKET


When Dannin teaches her students about privatization, she uses the analogy of personal finance. "If I find my income does not meet my expenses, I can cut my expenses, but there are certain things I have to have," she said. To meet those needs a person can get a second job. In the case of the government, it can raise taxes.

But "that is not an option governments see anymore," she told us. "So the third option is to buy a lottery ticket — and that’s what privatization is."

When a publicly owned road is leased for 99 years to a private company, the politician who cut the deal gets a huge chunk of cash up front to balance the local budget or meet another need. When the new owner of the road puts in a tollbooth to recoup costs, that’s the tax the politician, who may be long gone, refused to impose. What option does the voting driver have now?

Public goods, from which everyone presumably benefits, are frequently and easily falling out of the hands of government and into the hands of profit-driven companies. In New Orleans, charter schools have replaced all but four public schools. In about 15 municipalities public libraries are now managed by the privately owned Library Systems and Services. (In Jackson County, Ore., it’s being done for half the cost, but with half the staff and open half the hours.) At least 21 states are considering public-private partnerships to finance massive improvements to aging roads and bridges. User fees have increased in the national parks as rangers have been laid off and some of the work of park interpretation is picked up by private companies, as is the case with Alcatraz Island.

Dannin also asks her students to consider who really owns a job. The easy answer is the employer. "But there is another claimant of ownership of that job," she says. "That is the public. Employers depend on roads for their employees to drive to work, a public education system to train their workers. They depend on housing, police, the court system, the system of laws. That is a huge amount of infrastructure we tend not to think about.

"We live within an ecosystem. We’re having a hard time seeing that ecosystem, that infrastructure that we’re all in. That’s what your taxes pay for."

Mayor Gavin Newsom has created an entirely new branch of city government that is private, funded by undisclosed corporate donations, staffed by volunteers who are often city employees or his campaign donors, and unaccountable to any internal controls or outside scrutiny.

Yet rather than being a cause for concern, Newsom has touted San Francisco Connect and its four subprograms — Project Homeless Connect, Tech Connect, Green Connect, and Project Children and Families Connect — as his proudest achievement, a model he is actively exporting to other cities.

According to its Web site, "The mission of SF Connect is to mobilize residents and sectors for a stronger San Francisco. SF Connect is about engaged residents volunteering their talent and time for the City, as well as innovative partnerships between the private, public, and social [nonprofit] sectors."

Green Connect (and "partners" that include Pacific Gas and Electric Co. and Oracle), does cleanup and tree planting. Tech Connect (and partners Netgear.com and Hewlett Packard) works on "digital inclusion." And Project Homeless Connect (Gap, Visa, AT&T, Blue Shield, IBM, the Hotel Council, and Charles Schwab among its partners) does homeless outreach events.

During his endorsement interview with the Guardian, we asked Newsom about the programs and how they allow the private sector to take a more active role in delivering public services on behalf of city government, sometimes with the help of public resources. Is that a model he likes?

"Oh, you’d better believe that!" Newsom said. "Am I for actual responsibility and civic service and duty? You’d better believe it. I think it should be mandated for everyone who graduates from our public education system. I think they should be forced to give back and contribute in community service. What the Connects are all about is community service and connecting the dots. The Rec Connects, which may be what you’re referring to, is a way of leveraging resources and getting more of our [community-based organizations] involved."

All of those involved with SF Connect also seem to sing its praises. But there’s another side to Newsom’s feel-good approach to delivering public services: they often displace social services delivered by qualified providers, supplement underfunded city services with private providers rather than simply fixing and funding them, provide wedges for corporations to take over public spheres (as the Google-EarthLink wi-fi deal through Tech Connect very nearly did), and allow corporations to buy influence with unregulated contributions to a politician’s pet program.

"If you look at the ways of privatizing, volunteering is one, and it sounds nice," said Margot Reed, an organizer with Service Employees International Union Local 1021.

Yet that volunteerism sometimes replaces services that previously were provided by government or nonprofit agencies whose contracts and performance could be scrutinized. But Newsom’s approach through SF Connect doesn’t allow that kind of transparency.

To illustrate the problem, the Guardian made a Sunshine Ordinance records request to the Mayor’s Office, asking for a complete breakdown of the budgets of all the Connect programs. The office refused to provide the information, referring us instead to SF Connect, but that organization has a history of refusing to provide the Guardian and other media organizations with its budget and donor lists.

Last year the San Francisco Chronicle fought the Newsom administration for two months to get it to reveal the donor list, finally winning the release of the names of donors who had agreed to be disclosed (some asked for their money to be returned instead). SF Connect’s donors included PG&E, which gave $25,000; Google investor Ron Conway, who gave $100,000; Wells Fargo Bank, which gave $20,000; and Carmen Policy (the former 49ers top dog who was recently named to push a June ballot measure on a new stadium that Newsom wants to build), who gave $2,500. Other donors included Newsom appointees, contributors, and companies that do business with the city.

When we tried to get a current list of donors, staffers didn’t respond to Guardian phone calls or e-mails.

We also asked Newsom’s office for a complete breakdown of city staff time, money, and other resources that have gone into supporting the Connect programs, knowing that city staff have been involved in their events and e-mails have gone out from city offices.

"There is no line item in any budgets nor any reporting within our office on time spent coordinating with SF Connect," Joe Arellano from the Mayor’s Office of Communications responded by e-mail after repeated requests for answers.

That’s probably because there seems to be no clear line drawn between where the private SF Connect ends and where the public-sector Mayor’s Office begins. Call the phone number on the San Francisco Connect Web site for Project Homeless Connect, and it rings at the desk of Judith Crane in the Department of Public Health.

Even getting a list of privatization proposals by Newsom hasn’t been easy. The Mayor’s Office cited technical inadequacies when we asked it to search all of Newsom’s speeches, press releases, e-mails, and other documents for the words "public-private partnership," a favorite Newsom phrase.

We know that he’s unsuccessfully sought to privatize jail health services, security at the Asian Art Museum, and the city’s golf courses (see "Bilking the Links," page 22) and to create a citywide wireless Internet system run by Google and EarthLink.

But ask Newsom about it, as we did, and you’ll hear his semantic gymnastics: "Privatization is failing, so I’m not pro-privatization. I don’t look to privatize. I look for ways to manage more creatively and more efficiently."

William M. Tweed was one of the greatest crooks in American political history, a notorious Tammany Hall boss in New York who managed in the course of just a few years, starting in 1870, to steal more than $75 million (the equivalent of more than $1 billion today) from the city coffers. The way he did it was simple. As Elliott Sclar, a Columbia economist and expert on privatization, notes, Tweed took advantage of the fact that much of the work of city government was contracted out to private companies. Boss Tweed controlled the contracts; the contractors overcharged the city by vast sums and kicked back the money to Tammany Hall.

This is a rather extreme example, but not, Sclar argues, an atypical one: the worst corruption scandals in American history usually involve private contractors and public money. In fact, he argues, privatization is almost by its nature a recipe for scandal and corruption.

Nothing in the public sector — no incompetence, no waste, no bureaucratic bungling — begins to compare with what happens when private operators get their hands on public money. And the cost of monitoring contracts, making sure contractors don’t cheat or steal, and forcing them to act in ways that reflect the public interest is so high that it dwarfs any savings that privatization seems to offer.

That’s the message of the Guardian‘s 41st anniversary issue.

It’s relatively easy to investigate government malfeasance. The records are public, the players are visible, and the laws are on the side of the citizens.

But when Bruce B. Brugmann started the Guardian in 1966 with his wife, Jean Dibble, he realized that the real scandals often took place outside City Hall. They involved the real powerful interests, the giant corporations and big businesses that were coming to dominate the city’s skyline and its political life. The details were secretive, the money hidden.

One of the first big stories the paper broke, in 1969, involved perhaps the greatest privatization scandal in urban history, the tale of how Pacific Gas and Electric Co. had stolen San Francisco’s municipal power, to the tune of hundreds of millions of dollars. The famous Abe Ruef municipal graft scandals of the early 20th century, the Guardian wrote, were "peanuts, birdseed compared to this."

When I first came to work here, in 1982, Brugmann used to tell me that daily papers, which loved to try to expose some poor soul who was collecting two welfare checks or a homeless person who was running a panhandling scam, were missing the point. "If you look hard enough, you can always find a small-time welfare cheat," he’d tell me. "We want to know about corporate welfare, about the big guys who are stealing the millions."

And there were plenty.

In his new book Supercapitalism: The Transformation of Business, Democracy, and Everyday Life (Knopf), Robert Reich, the economist and former secretary of labor, argues that during the cold war, when American politicians railed against the socialist model of economic planning, this country actually had a carefully planned economy. The planning wasn’t done by elected officials; it was done by a handful of oligarchic corporations and military contractors.

Modern San Francisco was born in that same cauldron. During World War II, captains of industry and military planners took control of the city’s economy, directing resources into the shipyards, collecting labor from around the country to build and repair Navy vessels, and making sure the region was doing its part to defeat the Axis powers. It worked — and when the war ended the generals went away, but the business leaders stayed and quietly, behind closed doors, created a master plan for San Francisco. Downtown would become a new Manhattan, with high-rise office buildings and white-collar jobs. The East Bay and the Peninsula would be suburbs, with a rail line (BART) carrying the workers to their desks. Private developers, working under the redevelopment aegis, demolished low-income neighborhoods to build a new convention center and hotels.

Nobody ever held a public hearing on the master plan. And it wasn’t until the late 1960s that San Franciscans figured out what was going on.

By 1971 the fight against Manhattanization began to dominate the Guardian‘s political coverage. It would play center stage in San Francisco politics for two more decades. The paper ran stories about high-rises and freeways and environmental impact reports, but the real issue was the privatization of the city’s planning process.

Ronald Reagan soared into the White House in 1980, rolling over a collapsing Jimmy Carter and a demoralized, moribund Democratic Party. Reagan and his backers had an agenda: to dismantle American government as we knew it, to roll back the New Deal and the Great Society, to get the public sector out of the business of helping people and give the benefits to private business. "Government," Reagan announced, "isn’t the solution. Government is the problem."

The Guardian was firmly planted on the other side. We supported public power, public parks, public services, public accountability. We had no blinders about the flaws of government agencies — I spent much of my time in the early years writing about the mess that was Muni — but in the end we realized that at least the public sector carried the hope of reform. And we saw San Francisco as a beacon for the nation, a place where urban America could resist the Reagan doctrine.

Unfortunately, the mayor of San Francisco in the Reagan years might as well have been a Republican. Dianne Feinstein’s faith in the private sector rivaled that of the new president. She turned the city’s future over to the big real estate developers. She vetoed rent control and gave the landlords everything they wanted. And when the budget was tight, she ignored our demands that downtown pay its fair share and instead raised bus fares and cut library hours.

When gay men started dying of a strange new disease, there was no public money or service program to help them, from Washington DC or San Francisco. So the community was forced to build a private infrastructure to take care of people with AIDS — and years later, as Amanda Witherell notes in this issue, those private foundations became secretive and unaccountable.

In 1994 we got a tip that something funny was going on at the Presidio. The Sixth Army was leaving and turning perhaps the most valuable piece of urban real estate on Earth over to the National Park Service … in theory. In practice, we learned, some of the biggest corporations in town had come together with a different plan — to create a privatized park — and Rep. Nancy Pelosi was carrying their water. Every detail of the Presidio privatization made the front page of the Guardian — and still, the entire Democratic Party power structure (and much of the environmental movement) lined up behind Pelosi. Now we have a corporate park on public land, with that great pauper George Lucas winning a $60 million tax break to build a commercial office building in a national park.

And still, it continues.

Mayor Gavin Newsom, a rising star in the Democratic Party, who told us he’s no fan of privatization, demonstrated the opposite in one of his signature political campaigns this year: he tried (and is still trying) to turn over the city’s broadband infrastructure — something that will be as important in this century as highways and bridges were in the last — to a private company. That’s what the whole wi-fi deal (now on the ballot as Proposition J) is about; the city could easily and affordably create its own system to deliver cheap Internet access to every resident and business. Instead, Newsom wants the private sector to do the job.

The Department of Public Health is running public money through a private foundation in a truly shady deal. The mayor’s Connect programs operate as public-private partnerships. Newsom wants to privatize the city’s golf courses, and maybe Camp Mather. He’s prepared to give one of the worst corporations in the country — Clear Channel Communications — the right to build and sell ads on bus shelters (and nobody has ever explained to us why the city can’t do that job and keep all the revenue). Housing policy? That depends entirely on what the private sector wants — and when we challenged Newsom on that in a recent interview, he snidely proclaimed that the city simply has to follow the lead of the developers because "we don’t live in a socialist society."

This is not how the city of San Francisco ought to be behaving. Because when you give public land, public services, public institutions, and public planning initiatives to the private sector, you get high prices, backroom deals, secrecy, corruption — and a community that’s given up on the notion of government as part of the solution, not just part of the problem.

You start acting like the people who have been running Washington DC since 1980 — instead of promoting a city policy and culture that ought to be a loud, visible, proud, and shining example of a different kind of America.

The fall of the Berlin Wall in 1989 led a lot of pundits to talk about “the end of History.” The big battle of our lives, the defining philosophical and political conflict of the century, was over. Communism lost. Capitalism won.

But in the United States, the real war was just getting under way, a conflict between two visions of society: in one, the public sector, operating under a democratic system, dominated economic and political life; in the other, the central players in the game of life were private corporations. This war, which drags on today, poses a profound question: does the capitalist economy work for us — or are we slaves to its whims? The answer continues to transform almost every aspect of American life.

Clinton-era labor secretary Robert Reich, now a professor at UC Berkeley’s Goldman School of Public Policy, takes on a big piece of this epic struggle in his new book, Supercapitalism: The Transformation of Business, Democracy and Everyday Life. The cogent, well-documented, and critically important argument he makes is that the American people have prospered as consumers and investors at the expense of their role as citizens.

And in the end, we’ve been hurting ourselves.
This is the essential paradox of modern global capitalism: you can buy high-end electronics cheap, get amazing bargains at Wal-Mart, enjoy the growth of your 401(k) plan — and in the process, become poorer. Because the race to the bottom of the price chain and the top of the market has costs, and in the end, we’re all paying them. The only solution, Reich says, is a more aggressive government: more regulation, higher taxes, and, quite possibly, some consumer and investor sacrifices.

Reich goes back to what he calls the “Not Quite Golden Age,” the roughly 25 years after the end of World War II that were marked by continuous economic growth, relative prosperity, and remarkable (compared with today) economic equality. The top tax rate, for the very rich, was 91 percent (compared with 35 percent today). American industry was controlled by an oligopoly, in which a handful of businesses held the reins — and because they faced little competition, they were able to share their profits with labor. Back then, companies didn’t distribute their wealth to investors; it went to the employees.

For all the denunciation of socialism and idolization of the free market that goes on in American politics today, Reich points out that cold war America was defined by centralized economic planning. It just wasn’t the government doing that job; it was private industry.

He doesn’t contend that the model in operation back then was perfect — and anyone who has followed the postwar transformation of San Francisco, driven by secret private-sector planning, knows the painful impacts of such policies. But public resources were adequate to pay for massive infrastructure advances (the interstate highway system), gigantic educational benefits (the GI bill), and phenomenal tax breaks for home ownership. Labor unions, dealing with domestic companies that didn’t face competitors with cheaper offshore labor, were able to negotiate a division of the wealth that helped create the modern American middle class.

The gap between rich and poor was much, much smaller during that period than it is today; as Reich notes, “the potent incentive of great wealth was often absent,” so the economy was far more equitable and stable. High taxes on the rich didn’t slow a period of remarkable economic growth. And in 1964, 75 percent of the American public thought the government could be trusted to do the right thing most of the time — a statistic that seems inconceivable today.

That was, of course, before Vietnam, before Watergate, before the (first) energy crisis, stagflation, the California tax revolt, and cultural disillusion with the public sector, factors Reich doesn’t discuss in great detail.

But he does point to the changes that came in the 1980s and later: Deregulation, which transformed the banking industry, turning savers into investors. Globalization, which created a cutthroat type of capitalism promoting low prices and high returns at any cost. And government policies — such as the creation of private retirement plans and the promotion of the stock market as the central tool of investment — that encouraged Americans to focus on their own bottom line and ignore the larger issues facing society.

The result today, Reich says, is a supercapitalist world, in which you can fill your house with amazing piles of cheap stuff — but in the end those bargains wind up hurting you. “Consumers get great deals because workers get shafted,” he notes. “Ironically, they’re often the same people.”

Unlike a lot of people on the left, Reich doesn’t go around bashing big corporations and blaming them for society’s ills. In today’s ultracompetitive world, he says, corporations are simply doing what they have to do to survive: cutting costs, fighting for the bottom line, striving for the best possible returns for investors. There is no such thing as corporate social responsibility, he argues; under supercapitalism, it’s all about making money.
Instead of complaining about corporate greed, he says, we need to think as citizens and demand new rules, new laws and regulations, that force companies to do what we want them to do. We have to take back control of the American economy — and to do that, we have to reclaim democracy.

Reich places a large part of the blame on the role money has assumed in politics. He suggests that corporations, which are in reality just paper constructs, should be stripped of any rights to legal standing, any rights to participate in the public process — any rights to act as anything but pieces of paper. Campaign contributions should all be put into blind trusts: anyone could give money to a candidate, but that candidate would never be allowed to know who gave what.

Those reforms would be tough, and they might not happen anytime soon. But the value of this book isn’t in promoting any specific policy prescription. It’s about waking up and educating several generations of Americans who can’t seem to understand that you can’t have it all for free: that a decent society with universal health care, good public education, safe cities, and a commitment to protecting the environment requires some sacrifice; that the very rich (and even the run-of-the-mill well-off) among us have to pay taxes and accept responsibility for a decent nation and a decent world. That means creating a public sector we can trust — and not dismissing out of hand the notion that government has a positive role to play.

It’s the most important message anyone can impart today to the deluded, selfish population that makes up so much of modern America.
