THEATER Leave it to a small and scrappy low-to-no-budget theater company to revive, at just the right time, Dario Fo’s We Won’t Pay! We Won’t Pay! Fo, Italy’s esteemed latter-day commedia dell’arte rabble-rouser — the first clown (who really is a clown) to win a Nobel Prize — crafted this gem in inspired response to another period of social-economic bullshit, the tumultuous mid-1970s, when Italy was suffering the brunt of the “stagflation” resulting from an oil-triggered worldwide downturn. Fo’s 1974 farce draws on the real-life price rebellions and grocery-store riots carried out by Italy’s (financially) desperate housewives for a very funny and pointed tale of revolutionary high jinx in the domestic sphere. And Eastenders’ production, confidently helmed by artistic director Susan E. Evans, does it full justice. But the company doesn’t stop there: the second half of the evening is devoted to one of two series of new shorts plays (running in repertory) that take the Fo piece and run with it, in varying contemporary directions.

We Won’t Pay! takes up the bulk of the evening and remains the highlight, however, especially in Ron Jenkins’ lively translation, delivered shrewdly by a strong cast with palpable personality and fine comic instincts. Its homey scenario connects the personal and political effortlessly, as a bright working-class housewife named Antonia (a deft and utterly charming Beatrice Basso) tries to hide from her morally upstanding husband, Giovanni (a drolly pompous yet amiable Craig Dickerson), the groceries stolen in an exhilarating impromptu rebellion at the local market. Upright citizens and the coercive unjust hierarchies they protect are, of course, turned right on their head in the process. Even the policeman who shows up at the door (one of several supporting roles essayed with skill and aplomb by Matt Weimer) has had about enough of the whole system. By the end, an agitprop spirit takes over as Giovanni spouts what by now seems the most commonsensical thing — rebellion — as curtain and forth wall come down.

Often cleaving a little too closely to the original material, the playlets that follow in the second act can have the feel of an exercise rather than a fully wrought play of whatever length. But there are some small surprises to be found along the way. Actor Jeff Thompson strikes just the right pitch of whimsy and incipient political consciousness as he digests what has just gone before from the perspective of an incidental stage property, namely A Frozen Rabbit Head, in Gene Mocsy’s playful monologue of the same name. And playwright Isaiah Dufort’s A Statement shifts the opening scene between Antonia (Tristan Cunningham) and neighbor Margherita (Katarina Fabic) just enough to give it a distinctly Bay Area edge, nicely realized by the actors under Amy K. Kilgard’s direction. Less satisfying are the next two in the series, Jeff Thompson’s The Report, which strains after meaning and humor in a beat cop’s political awakening, and Scott Munson’s Safeway Encounter, which begins promisingly but soon gets off-kilter, charging headlong down broadly absurd aisles of no return. In the end, it’s a mixed bag, rabbit heads and all, but nourishing just the same.

Who profits from ICE’s electronic monitoring anklets?

One of the many troubling things to emerge from the threatened deportation of the wife and stepsons of Muni bus driver Charles Washington is the extent to which the Department of Homeland Security (DHS) is using electronic monitoring bracelets to track immigrants–and is turning to private contractors to deliver these services.
Take the Washingtons’ case. Charles Washington told reporters that US Immigration and Customs Enforcement (ICE) told him they would release his teenage stepson, if his wife Tracey, went to ICE’s Sansome Street office in San Francisco and agreed to wear an electronic anklet (pictured below).

Tracey Washington agreed to the deal, worried about her 13-year old son, who had spent close to a week in detention at juvenile hall, after he got into a fight at school over 46 cents, and who was now in the hands of federal immigration authorities. And she had cause to worry. The feds have been known to transfer teenage immigrants arrested in San Francisco to detention facilities in Florida, Virginia and Oregon, while their deportation is pending.
So, the Washingtons hurried down to Sansome Street to retrieve their son.  And, there Tracey Washington was given deportation orders for herself and her son, and an electronic monitoring device, which contains a GPS device to monitor her movements 24/7, was placed around her ankle.
Tracey says the device was too tight at first, and, though it has since been adjusted, wearing it makes her feel as if she has committed a serious crime. But so far, no one in her family has actually been found guilty of a crime in this Kafkaesque episode.
Instead, her 13-year-old son has been charged with felony robbery, assault and extortion, charges that sound serious but have yet to be adjudicated in a juvenile justice court, and that were made in the wake of a schoolyard fight, which did not involve weapons, after the parent of the victim called the police.
But these felony charges are the reason why a juvenile probation officer called ICE, who picked up the boy, and, within 5 hours, released him to his mother, once they’d locked an electronic monitoring device on her ankle.
As for the question of the Washingtons’ visa overstay, which is ICE’s grounds for the anklet, the couple say they called the US Citizenship and Immigration Service (US CIS), not once, but twice, two days after they got married in April 2009, when Tracey, who met Charles on vacation six years ago, was midway through a 90-day visa waiver.
The couple say they were given misinformation on the phone about the urgency of applying for a green card, and that’s how they came to be only at the beginning of that process when their son got nabbed—a lag that Charles Washington attributes to the time it took for his family to save up the thousands of dollars that green card applications cost.
And apparently there is no way for the Washingtons or the US government to verify what happened when the couple called US CIS, and spoke to an operator. US CIS spokesperson Sharon Rummery told the Guardian that it is impossible to ascertain if a contractor with the US government misinformed the family.
‘I can’t say that it’s true or not, because it was a private conversation between one of the operators who works on our customer service line,” Rummery said. “Our operators are highly trained and are backed up by our trained officers,” Rummery continued, confirming that the operators are contractors, not US CIS staff.
Either way, Tracey Washington is left wearing an anklet. And as a hard-working, bus-driving US citizen, her husband Charles is not pleased that his tax dollars are being put to use in a way that leaves his wife stressed and feeling like a criminal.

“It’s my belief they are wasting tax payer money,” Washington said, eight days after US ICE granted his wife and stepson 60-day deportation reprieve. “With all the publicity this case has received, and the fact that our green card application has been sent in, I don’t see why she needs to be on the anklet. Everything that immigration has requested, we have complied with.”

So, just how widely spread is the use of anklets to track immigrants?

In 2002, federal immigration authorities created a $3 million Alternatives to Detention (ATD) program, to ensure that “aliens released from detention appear for their court hearings,” according to a 2010 ICE report.Fast forward to 2010 and the program’s FY 2010 budget is set at $69.9 million.
And somewhere along the way, the program began requiring immigrants who are in the process of applying for residency to wear electronic monitoring ankle bracelets 24/7—a requirement otherwise reserved for rapists, child molesters and other convicted criminals on parole.
This pilot program, which began in eight cities, including San Francisco, has since grown to a nationwide multimillion opportunity for contractors and now involves at least 30 cities: Atlanta, Charlotte, Baltimore, Boston, Hartford, Buffalo, Chicago, Kansas City, Dallas, Denver, Detroit, El Paso, Houston, Los Angeles, Delray Beach, Miami, Orlando, Newark, New Orleans, New York, Philadelphia, Phoenix, Portland, Seattle, San Francisco, Salt Lake City, San Antonio, San Diego, St. Paul and Washington.
In July 2009, DHS/ICE’s office of Detention and Removal Operations (DRO) awarded a $372 million, 5-year contract to BI Incorporated, a Boulder Colorado-based company, to provide support services for its Intensive Supervision Appearance Program  (ISAP) 11, as the federal government previously called its electronic monitoring program.
G4S Government Services of Atlanta, Georgia, which held the previous ISAP’s pilot contract, and put in a S489 million bid for ISAP 11, protested the BI award, arguing that DHS’ evaluation and BI’s price proposal were “unreasonable.”
Either way, DHS’ “statement of work” documents, which were posted online as part of that contract bid, suggest that ICE plans to use ATD on an even wider basis, in future.
“Approximately, 32,000 persons are held in secure detention by DRO each day,” the contract’s statement of work (SOW) section states, noting that this figure includes “aliens in the United States who are in violation of the Immigration and Nationality ACT (INA) who pose a threat to community safety, national security, and/or may be a flight risk, in addition to those aliens required to be detained under specific provisions of the INA.”
“Limited detention capacity and an increasing detainee population coupled with the need to lower alien absconder rates have sparked national efforts over the past several years to integrate into DRO’s general practices the use of various alternatives to detention for aliens who do not require mandatory detention in accordance with the INA,” the contract continues. “Alternatives to detention offer the prospect of a considerable cost savings over secure detention for eligible aliens.”
“Depending on available funding during the execution of the ISAP 11 contract, DRO intends to expand its ISAP coverage,” the contract notes. An attached appendix shows a list of 165 cities in which the program would operate nationwide. In addition to San Francisco and Los Angeles, California cities on the list include Bakersfield, San Diego, El Centro, Fresno, Imperial, Lancaster, Lompoc, Sacramento, San Jose, San Pedro, Santa Ana, Stockton, and Ventura.
Under the current contract, BI was expected to be fully prepared with sufficient staff and equipment to fulfill all statement of work requirements for 16,750 ISAP II slots, within two months of assuming control of the program. San Francisco was expected to fill 850 of these slots, putting it in fourth place behind Los Angeles (3,400 slots), New York, (1,500 slots) and Washington, D.C., (1,025).
And by the end of the five-year contract, the numbers of slots are expected to rise to 27,237 slots—a 10,487 increase, along with a steady increase in participating cities. Under those estimates, San Francisco is expected to have 957 slots five years from now,
The federal government touts ISAP, which relies on telephonic reporting, unannounced home visits, and regular face-to-face interviews, as well as electronic GPS monitoring devices, as a “cost-effective alternative to detention for aliens being processed through the Immigration Court system.”
ICE’s Lori Haley stressed that the program, with its focus on alternatives to detention, is part of the department’s “commitment to immigration reform.”
“Our mission is to ID non-citizens here without legal status and move them through the immigration process how the court sees fit,” Haley said.
She also stressed that the anklet program is preferable to detention and is suitable for folks with families who are not posing a danger to their community.
“We also found that as people get closer to the conclusion of the process, they may need a stronger level of monitoring,” Haley added, alluding to the reaction of folks on realizing that they are going to be deported after all.
These statistics paint a perhaps surprising picture to the average American, who likely wasn’t aware that there are thousands of immigrants in the US, who haven’t committed a serious crime, yet are walking around wearing these onerous, privacy-invading devices, hidden beneath their pants, or while they shower, or go to bed, while they await a ruling from the courts on their request to stay here permanently.
And these numbers are only going to grow bigger, if ICE has its way.
“Depending how long an alien remains in the ATD program and the number of individuals enrolled in the ATD program, implementing ATD nationwide would require between $88 million and $513 million,” ICE stated in its 2010 report to Congress. “The most realistic scenario for expansion requires a reduction in the average length in the ATD program to 180 days, down from the current average of 310 days. Reducing the average length on the program requires significant coordination within the Department of Justice, Executive Office for Immigration Review.”
“310 days in an anklet” sounds like the name of a funny film. Unfortunately for the 800 people in San Francisco, including Tracey Washington, who are apparently walking around wearing these devices in any given year, the situation is not funny, but it is all too real. And is this really the way to reform the federal immigration system in a humane and meaningful way?

The Girl on the Train André Téchiné’s beautifully photographed, ripped-from-the-headlines film explores the events that led a young Parisian girl to lie about being the victim of an anti-semitic attack. Téchiné’s dramatization fails as an account of the incident, but the film manages to evoke a powerfully mysterious tone due largely to two stellar performances, by Émilie Dequenne as the 20-something Jeanne and Catherine Deneuve as her persistent mother. Much of the running time follows Jeanne’s experiences before the fabrication, as she falls for (and moves in with) a young wrestler named Franck, before a tragic event causes Jeanne to invent the famous lie. An arty exploration into the psychology of victimization that happens to be anchored by a real-life event, The Girl on the Train may disappoint those looking for easy answers but is undeniable as a showcase for some outstanding acting. *Neil Young Trunk Show As loose as Jonathan Demme’s prior Neil doc Heart of Gold (2006) was tidy, with a taste for rave-ups where that film emphasized the mellower country-rock side, this neck-deep wade into Young’s four-decade-plus songbook is pretty dang nirvanic. Shot at the Tower Theater in Upper Darby, PA —exactly the kind of funky old midsized venue you’d want to see him at — it’s assembled via camera and editorial choices as seemingly random yet astute as Young’s grab bag of tunes. The latter range from historic hits ("Cinnamon Girl," "Harvest," "Cowgirl in the Sand") to more recent compositions ("The Believer," "No Hidden Path") and some real obscurities from the bottom of that trunk, including a few acoustic heartbreakers. Even shown out of concert order — there’s never any sense just where we are in the audience’s evening — they meld seamlessly, the epic half-hour oceanics of "Path" just as well as something small and plaintive like "Sad Movies." Never in better voice (qualify that as you will) at age 65, surrounded by an assured band of five plus scattered oddball props and one live canvas painter, Young is the eye of this particular hurricane — even if "Like a Hurricane" is the one performance that feels a tad uninspired. If you’re a fan, this will be pretty close to sheer ecstasy. If not … well, frankly, I have absolutely no idea whether
you’ll be converted, mildly entertained, or bored to death. (1:22) Lumiere, Shattuck. (Harvey)

Repo Men Nope, not a sequel to the 1984 cult classic. Jude Law and Forest Whitaker will, however, relieve you of your futuristic mechanical organs if you can’t pay for them post-transplant. (1:53) Shattuck.

The Runaways In Floria Sigismondi’s tale of the rise and fall of a 1970s all-girl band, LA producer Kim Fowley (Michael Shannon) proclaims that the Runaways are going to save rock and roll. It’s hard to gauge the sincerity of this pronouncement, but you can certainly hear, in songs like "Cherry Bomb" and "Queens of Noise," how the band must have brightened a landscape overrun by kings of prog rock. Unfortunately, a handful of teenagers micromanaged by a sleazy, abusive nutcase proved not quite up to the task, though the band did launch the careers of metal guitarist Lita Ford (Scout Taylor-Compton) and, more famously, Joan Jett (Kristen Stewart). Sigismondi’s film entertainingly sketches the Runaways’ beginnings in glam rock fandom and gradual attainment of their own rabid fan base. We get Currie lip-synching Bowie to catcalls at the high school assembly, Jett composing "Cherry Bomb" with Fowley, glamtastic hair-and-wardrobe eye candy, pills-and-Stooges-fueled intra-band fooling around, and five teenage girls sent off sans chaperone on an international tour with substantial quantities of hard drugs in their carry-on luggage. What follows is less pretty: a capsule version of the band’s disintegration after the departure of bottoming-out 16-year-old lead singer Cherie Currie (Dakota Fanning). In a film darkened by Currie’s trajectory, Jett’s subsequent success is a feel-good coda, but it’s awkwardly attached and emblematizes one of The Runaways‘ main problems. When the band begins to fall apart, the film doesn’t know which way to turn and ends up telling no one’s story well. (1:42) Bridge. (Rapoport)

Ajami You may recognize the title of Yaron Shoni and Scandar Copti’s debut collaboration as one of five films nominated for a 2010 Academy Award in the Foreign Category. Though it didn’t bring home the grand prize, Ajami remains a complex and affecting story about desperation and its consequences in a religiously-mixed town in Israel. As we follow the lives of four of Ajami’s residents the narrative shifts perspective almost maddeningly, switching characters seemingly at the height of each story’s action. But once all of the stories fully intersect, the final product has the distinction of feeling both meticulously calculated and completely natural. I was most impressed to learn that Shani and Copti prepared their actors with improvised role-playing rather than scripts. By withholding what was going to happen in a scene before shooting, we are treated to looks of surprise and emotion on actor’s faces that never feel unnatural. Attaining such a level of realism may be Ajami‘s crowning achievement; it can’t have been easy to make a foreign world feel so familiar. (2:00) Embarcadero, Shattuck. (Galvin)

Alice in Wonderland Tim Burton’s take on the classic children’s tale met my mediocre expectations exactly, given its months of pre-release hype (in the film world, fashion magazines, and even Sephora, for the love of brightly-colored eyeshadows). Most folks over a certain age will already know the story, and much of the dialogue, before the lights go down and the 3-D glasses go on; it’s up to Burton and his all-star cast (including numerous big-name actors providing voices for animated characters) to make the tale seem newly enthralling. The visuals are nearly as striking as the CG, with Helena Bonham Carter’s big-headed Red Queen a particularly marvelous human-computer creation. But Wonderland suffers from the style-over-substance dilemma that’s plagued Burton before; all that spooky-pretty whimsy can’t disguise the film’s fairly tepid script. Teenage Alice (Mia Wasikowska) displaying girl-power tendencies is a nice, if not surprising, touch, but Johnny Depp’s grating take on the Mad Hatter will please only those who were able to stomach his interpretation of Willy Wonka. *The Art of the Steal How do you put a price on something that’s literally priceless? The Art of the Steal takes an absorbing look at the Barnes Collection, a privately-amassed array of Post-Impressionist paintings (including 181 Renoirs) worth billions — and the many people and corporate interests who schemed to control it. Founder Albert C. Barnes was an singular character who took pride in his outsider status; he housed his art in a specially-constructed gallery far from downtown Philadelphia’s museum scene, and he emphasized education and art appreciation first and foremost. But he had no heirs, and after his death in 1951, opportunists began circling his massive collection; the slippery political and legal dealings that have unfolded since then are nearly as jaw-dropping as Barnes’ prize paintings. Philly documentarian Don Argott has a doozy of a subject here, and his skillful, even suspenseful film does it justice. (1:41) Elmwood, Opera Plaza, Smith Rafael. (Eddy)

Avatar James Cameron’s Avatar takes place on planet Pandora, where human capitalists are prospecting for precious unobtainium, hampered only by the toxic atmosphere and a profusion of unfriendly wildlife, including the Na’vi, a nine-foot tall race of poorly disguised cliches. When Jake Sully (Sam Worthington), a paraplegic ex-marine, arrives on the planet, he is recruited into the "Avatar" program, which enables him to cybernetically link with a part-human, part-Na’vi body and go traipsing through Pandora’s psychedelic underbrush. Initially designed for botanical research, these avatars become the only means of diplomatic contact with the bright-blue natives, who live smack on top of all the bling. The special effects are revolutionary, but the story that ensues blends hollow "noble savage" dreck with events borrowed from Dances With Wolves (1990) and FernGully: The Last Rainforest (1992). When Sully falls in love with a Na’vi princess and undergoes a spirit journey so he can be inducted into the tribe and fight the evil miners, all I could think of was Kevin Bacon getting his belly sliced in The Air Up There (1994). The Blind Side When the New York Times Magazine published Michael Lewis’ article "The Ballad of Big Mike" — which he expanded into the 2006 book The Blind Side: Evolution of a Game — nobody could have predicated the cultural windfall it would spawn. Lewis told the incredible story of Michael Oher — a 6’4, 350-pound 16-year-old, who grew up functionally parentless, splitting time between friends’ couches and the streets of one of Memphis’ poorest neighborhoods. As a sophomore with a 0.4 GPA, Oher serendipitously hitched a ride with a friend’s father to a ritzy private school across town and embarked on an unbelievable journey that led him into a upper-class, white family; the Dean’s List at Ole Miss; and, finally, the NFL. The film itself effectively focuses on Oher’s indomitable spirit and big heart, and the fearless devotion of Leigh Anne Tuohy, the matriarch of the family who adopted him (masterfully played by Sandra Bullock). While the movie will delight and touch moviegoers, its greatest success is that it will likely spur its viewers on to read Lewis’ brilliant book. (2:06) Elmwood, Oaks. (Daniel Alvarez)

Brooklyn’s Finest "Really? I mean, really?" asked the moviegoer beside me as the final freeze-frame of Brooklyn’s Finest slapped our eyeballs. Yes, that’s the sound of letdown, despite the fact that Brooklyn’s Finest initially resembled a promisingly gritty juggling act in the mode of The Wire and Cop Land (1997), Taxi Driver (1976) and Training Day (2001). Bitter irony flows from the title — and from the lives, loves, bad habits, pressure-cooker stress, and unavoidable moral dilemmas of three would-be everyday cops, all occupying several different rungs on a food chain where right and wrong have an unpleasant way of switching sides. Eddie (Richard Gere) is the veteran officer just biding his time till he gets his pension, all while comforting himself with the meager sensuous attentions of hooker Chantel (Shannon Kane). Sal (Ethan Hawke) is the bad detective, stealing from the dealers to fund a dream home for his growing family with Angela (Lili Taylor). Tango (Don Cheadle) is the undercover detective who has cultivated friendships with dealers like Caz (Wesley Snipes) and sacrificed his marriage for a long-promised promotion from his lieutenant (Will Patton) and his superior (Ellen Barkin, in likely the most misogynist portrayal of a lady with a badge to date). You spend most of Brooklyn’s Finest waiting for these cops to collide in the most unfortunate, messiest way possible, but instead the denouement leaves will leave one wondering about unresolved threads and feeling vaguely unsatisfied. In any case, director Antoine Fuqua and company seem to pride themselves on their tough-minded if at times cartoonish take on law enforcement, with Hawke in particular turning in a memorably OTT and anguished performance. The Crazies Disease and anti-government paranoia dovetail in this competent yet overwhelmingly non-essential remake of one of George A. Romero’s second-tier spook shows. In a small Iowa hamlet overseen by a benevolent sheriff (Timothy Olyphant) and his pregnant wife (Radha Mitchell), who’s also the town doctor, a few odd incidents snowball into all-out chaos when a mysterious, unmarked plane crashes into the local water supply. Before long, the few residents who aren’t acting like homicidal maniacs are rounded up by an uber-aggressive military invasion. Though our heroes convey frantic panic as they try to figure out what the hell is going on, The Crazies never achieves full terror mode. It’s certainly watchable, and even enjoyable at times. Crazy Heart "Oh, I love Jeff Bridges!" is the usual response when his name comes up every few years for Best Actor consideration, usually via some underdog movie no one saw, and the realization occurs that he’s never won an Oscar. The oversight is painful because it could be argued that no leading American actor has been more versatile, consistently good, and true to that elusive concept "artistic integrity" than Bridges over the last 40 years. It’s rumored Crazy Heart was slotted for cable or DVD premiere, then thrust into late-year theater release in hopes of attracting Best Actor momentum within a crowded field. Lucky for us, this performance shouldn’t be overlooked. Bridges plays "Bad" Blake, a veteran country star reduced to playing bars with local pickup bands. His slide from grace hasn’t been helped by lingering tastes for smoke and drink, let alone five defunct marriages. He meets Jean (Maggie Gyllenhaal), freelance journalist, fan, and single mother. They spark; though burnt by prior relationships, she’s reluctant to take seriously a famous drunk twice her age. Can Bad handle even this much responsibility? Meanwhile, he gets his "comeback" break in the semi-humiliating form of opening for Tommy Sweet (Colin Farrell) — a contemporary country superstar who was once Bad’s backup boy. Tommy offers a belated shot at commercial redemption; Jean offers redemption of the strictly personal kind. There’s nothing too surprising about the ways in which Crazy Heart both follows and finesses formula. You’ve seen this preordained road from wreckage to redemption before. But actor turned first-time director Scott Cooper’s screenplay honors the flies in the windshield inherited from Thomas Cobb’s novel — as does Bridges, needless to say. *An Education The pursuit of knowledge — both carnal and cultural — are at the tender core of this end-of-innocence valentine by Danish filmmaker Lone Scherfig (who first made her well-tempered voice heard with her 2000 Dogme entry, Italian for Beginners), based on journalist Lynn Barber’s memoir. Screenwriter Nick Hornby breaks further with his Peter Pan protagonists with this adaptation: no man-boy mopers or misfits here. Rather, 16-year-old schoolgirl Jenny (Carey Mulligan) is a good girl and ace student. It’s 1961, and England is only starting to stir from its somber, all-too-sober post-war slumber. The carefully cloistered Jenny is on track for Oxford, though swinging London and its high-style freedoms beckon just around the corner. Ushering in those freedoms — a new, more class-free world disorder — is the charming David (Peter Sarsgaard), stopping to give Jenny and her cello a ride in the rain and soon proffering concerts and late-night suppers in the city. He’s a sweet-faced, feline outsider: cultured, Jewish, and given to playing fast and loose in the margins of society. David can see Jenny for the gem she is and appreciate her innocence with the knowing pleasure of a decadent playing all the angles. The stakes are believably high, thanks to An Education‘s careful attention to time and place and its gently glamored performances. Scherfig revels in the smart, easy-on-eye curb appeal of David and his friends while giving a nod to the college-educated empowerment Jenny risks by skipping class to jet to Paris. And Mulligan lends it all credence by letting all those seduced, abandoned, conflicted, rebellious feelings flicker unbridled across her face. (1:35) Oaks, Smith Rafael. (Chun)

*The Ghost Writer Roman Polanski’s never-ending legal woes have inspired endless debates on the interwebs and elsewhere; they also can’t help but add subtext to the 76-year-old’s new film, which is chock full o’ anti-American vibes anyway. It’s also a pretty nifty political thriller about a disgraced former British Prime Minister (Pierce Brosnan) who’s hanging out in his Martha’s Vineyard mansion with his whip-smart, bitter wife (Olivia Williams) and Joan Holloway-as-ice-queen assistant (Kim Cattrall), plus an eager young biographer (Ewan McGregor) recently hired to ghost-write his memoirs. But as the writer quickly discovers, the politician’s past contains the kinds of secrets that cause strange cars with tinted windows to appear in one’s rearview mirror when driving along deserted country roads. Polanski’s long been an expert when it comes to escalating tension onscreen; he’s also so good at adding offbeat moments that only seem tossed-off (as when the PM’s groundskeeper attempts to rake leaves amid relentless sea breezes) and making the utmost of his top-notch actors (Tom Wilkinson and Eli Wallach have small, memorable roles). Though I found The Ghost Writer‘s ZOMG! third-act revelation to be a bit corny, I still didn’t think it detracted from the finely crafted film that led up to it. Green Zone Titled for the heavily-guarded headquarters of international occupation in Baghdad, Green Zone reunites director Paul "Shaky-Cam" Greengrass with star Matt Damon, the two having previously collaborated on the last two Bourne films. Instead of a super-soldier, this time around Damon just plays a supremely insubordinate one as he attempts to uncover the reason why his military unit can’t find any of Saddam’s WMDs. With the aid of the CIA, a Wall Street Journal reporter and a friendly Iraqi, Damon goes rogue in order to suss out the source of the misinformation. The Iraq War action is decent if scarce, but an overindulgence in (you guessed it) shaky-cam and political jargon cannot hide the fact that Green Zone‘s plot is simplistic and probably light on actual facts. Damon makes a fine cowboy-cum-hero, but the effectiveness of the mix of patriotism and Pentagon paranoia will vary based on your penchant for such things. Still, Green Zone moves fast enough that it remains worth a matinee for conspiracy thriller aficionados. (1:55) California, Empire, 1000 Van Ness, Piedmont, Sundance Kabuki. (Galvin)

The Hurt Locker When the leader of a close-knit U.S. Army Explosive Ordnance Disposal squad is killed in action, his subordinates have barely recovered from the shock when they’re introduced to his replacement. In contrast to his predecessor, Sgt. James (Jeremy Renner) is no standard-procedure-following team player, but a cocky adrenaline junkie who puts himself and others at risk making gonzo gut-instinct decisions in the face of live bombs and insurgent gunfire. This is particularly galling to next-in-command Sanborn (Anthony Mackie). An apolitical war-in-Iraq movie that’s won considerable praise for accuracy so far from vets (scenarist Mark Boal was "embedded" with an EOD unit there for several 2004 weeks), Kathryn Bigelow’s film is arguably you-are-there purist to a fault. While we eventually get to know in the principals, The Hurt Locker is so dominated by its seven lengthy squad-mission setpieces that there’s almost no time or attention left for building character development or a narrative arc. The result is often viscerally intense, yet less impactful than it would have been if we were more emotionally invested. Assured as her technique remains, don’t expect familiar stylistic dazzle from action cult figure Bigelow (1987’s Near Dark, 1989’s Blue Steel, 1991’s Point Break) — this vidcam-era war movie very much hews to the favored current genre approach of pseudo-documentary grainy handheld shaky-cam imagery. *The Last Station Most of the buzz around The Last Station has focused on Helen Mirren, who takes the lead as the Countess Sofya, wife of Leo Tolstoy (Christopher Plummer). Mirren is indeed impressive — when is she not? — but there’s more to the film than Sofya’s Oscar-worthy outbursts. The Last Station follows Valentin Bulgakov (James McAvoy), hired as Tolstoy’s personal secretary at the end of the writer’s life. Valentin struggles to reconcile his faith in the anarchist Christian Tolstoyan movement with his sympathy for Sofya and his budding feelings for fellow Tolstoyan Masha (Kerry Condon). For the first hour, The Last Station is charming and very funny. Once Tolstoy and Sofya’s relationship reaches its most volatile, however, the tone shifts toward the serious — a trend that continues as Tolstoy falls ill. After all the lighthearted levity, it’s a bit jarring, but the solid script and accomplished cast pull The Last Station together. Paul Giamatti is especially good as Vladimir Chertkov, who battles against Sofya for control of Tolstoy’s will. You’ll never feel guiltier for putting off War and Peace. (1:52) Albany, Opera Plaza. *The Most Dangerous Man in America: Daniel Ellsberg and the Pentagon Papers For many, Daniel Ellsberg is a hero — a savior of American First Amendment rights and one of the most outspoken opponents of the Vietnam war. But as this documentary (recently nominated for an Academy Award) shows, it’s never an an easy decision to take on the U.S. government. Ellsberg himself narrates the film and details his sleepless nights leading up to the leak of the Pentagon Papers — the top secret government study on the Vietnam war — to the public. Though there are few new developments in understanding the particulars of the war or the impact the release of the Papers had on ending the conflict, the film allows audiences to experience the famous case from Ellsberg’s point of view, adding a fresh and poignantly human element to the events; it’s a political documentary that plays more like a character drama. Whether you were there when it happened or new to the story, there is something to be appreciated from this tale of a man who fell out of love with his country and decided to do something about it. *North Face You’ll never think of outerwear the same way again — and in fact you might be reaching for your fleece and shivering through the more harrowing climbing scenes of this riveting historical adventure based on a true tale. Even those who consider themselves less than avid fans of outdoor survival drama will find their eyes frozen, if you will, on the screen when it comes to this retelling/re-envisioning of this story, legendary among mountaineers, of climbers, urged on by Nazi propaganda, to tackle the last "Alpine problem." At issue: the unclimbed north face of Switzerland’s Eiger, a highly dangerous and unpredictable zone aptly nicknamed "Murder Wall." Two working-class friends, Toni Kurz (Benno Fürmann of 2008’s Jerichow) and Andi Hinterstoisser (Florian Lukas) — here portrayed as climbing fiends driven to reach summits rather than fight for the Nazis — take the challenge. There to document their achievement, or certain death, is childhood friend and Kurz’s onetime sweetheart Luise (Johanna Wokalek, memorable in 2008’s The Baader Meinhof Complex), eager to make her name as a photojournalist while fending off the advances of an editor (Ulrich Tukur) seeking to craft a narrative that positions the contestants as model Aryans. But the climb — and the Eiger, looming like a mythical ogre — is the main attraction here. Filmmaker Philipp Stölzl brings home the sheer heart-pumping exhilaration and terror associated with the sport — and this specific, legendarily tragic climb — by shooting in the mountains with his actors and crew, and the result goes a way in redeeming an adventure long-tainted by its fascist associations. Our Family Wedding America Ferrera and Lance Gross play a couple of lovebirds who must jump through some serious family hoops before they get married in the mostly serviceable Our Family Wedding. What begins as a dual Guess Who’s Coming to Dinner, with the differences in each family’s traditions forcing complications and compromises, soon loses sight of its matrimonial plot as the focus steers towards a childish rivalry between the fathers. While it’s being marketed as a goofy comedy, the final product seeks a relatively sentimental tone, which makes the few slapstick moments — like a goat trying to rape Academy Award-winning actor Forest Whitaker — seem pretty inappropriate. Still, for some audiences the well-tread plot will act as comfort food: they fight, they make up, and it all ends in a big wedding where we watch the characters dance for damn near ten minutes. *Percy Jackson and the Olympians: The Lightning Thief It would be easy to dismiss Percy Jackson and the Olympians: The Lightning Thief as an unabashed Harry Potter knock-off. Trio of kids with magic powers goes on a quest to save the world in a Chris Columbus adaptation of a popular young adult series — sound familiar? But The Lightning Thief is sharp, witty, and a far cry from Columbus’ joyless adaptation of Harry Potter and the Sorcerer’s Stone (2001). Logan Lerman stars as Percy Jackson, the illegitimate son of Poseidon and Catherine Keener. Once he learns his true identity at Camp Half-Blood, he sets off on a quest with his protector, a satyr named Grover, and potential love interest Annabeth, daughter of Athena. Along the way, they bump into gods and monsters from Greek mythology — with a twist. Think Percy using his iPhone to fight Medusa (Uma Thurman), or a land of the Lotus-Eaters disguised as a Lady Gaga-blasting casino. A worthy successor to Harry Potter? Too soon to say, but The Lightning Thief is at least a well-made diversion. (1:59) 1000 Van Ness. (Peitzman)

*A Prophet Filmmaker Jacques Audiard has described his new film, A Prophet, as "the anti-Scarface." Yet much like Scarface (1983), A Prophet bottles the heady euphoria that chases the empowerment of the powerless and the rise of the long-shot loner on the margins. In its almost-Dickensian attention to detail, devotion to its own narrative complexity, and passion for cinematic poetry, A Prophet rises above the ordinary and, through the prism of genre, finds its own power. The supremely opportunistic, pragmatically Machiavellian intellectual and spiritual education of a felon is the chief concern of here. Played by Tahar Rahim with guileless, open-faced charisma, Malik is half-Arab and half-Corsican — and distrusted or despised by both camps in the pen. When he lands in jail for his six-year sentence, he’s 19, illiterate, friendless, and vulnerable. His deal with the devil — and means of survival — arrives with Reyeb (Hichem Yacoubi), temporarily locked up before his testifies against the mob. Corsican boss Cesar Luciani (Niels Arestrup) wants him dead, and Malik is tagged to penetrate Reyeb’s cell with a blade hidden in mouth. After Malik’s gory rebirth, it turns out that the teenager’s a seer in more ways than one. From his low-dog position, he can eyeball the connections linking the drugs entering the prison to those circulating outside, as well as the machinations intertwining the Arab and Corsican syndicates. It’s no shock that when Cesar finds his power eroding and arranges prison leaves for his multilingual crossover star that Malik serves not only his Corsican master, but also his own interests, and begins to build a drug empire rivaling his teacher’s. Throughout his pupil’s progress, Audiard demonstrates a way with Henri Cartier-Bresson’s decisive moment, and when Malik finally breaks with his Falstaffian patriarch, it makes your heart skip a beat in a move akin to the title of the director’s last film. This Eurozone/Obama-age prophet is all about the profit — but he’s imbued with grace, even while gaming for ill-gotten gain. (2:29) Embarcadero, Shattuck, Smith Rafael. (Chun)

Remember Me Ominously set in New York City during the summer of 2001, Remember Me, starring Robert Pattinson (of the Twilight series) and Emilie de Ravin (of TV’s Lost), pretty much answers the question of whether it’s still too soon to make the events of September 11 the subject of a date movie. Or rather, not the subject so much as the specter waiting just off-camera for its walk-on while brooding 21-year-old Tyler Hawkins (Pattinson) quotes Gandhi, gets into brawls, gets drunk, writes letters to his dead brother, and otherwise channels despondency and rage into various salubrious outlets. One of these is romancing (under circumstances severely testing the viewer’s credulity) de Ravin’s Ally Craig, grappling somewhat more constructively with her own familial tragedy. Ally is the sort of self-possessed, strong-willed young woman whose instincts, shortly after she’s been backhanded by her drunk father (Chris Cooper), tell her to placate and have sex with her drunk boyfriend when he comes home enraged after battling his own father (Pierce Brosnan). She is there to teach Tyler, through quirky habits like eating dessert first, what director Allen Coulter (2006’s Hollywoodland) wishes to teach us: that time is short and one must fill one’s life with meaningful actions — like throwing a fire extinguisher through a window to convince a classroom of tweens to stop bullying one’s little sister. The film is seeded with allusions to an impending catastrophe that feels less integrated than exploited. And it’s uncomfortable seeing the fall of the towers used to make the ground shake under a sweet, fairly depthless depiction of love and grief. (2:08) Empire, 1000 Van Ness, Sundance Kabuki. She’s Out of My League From the co-writers of the abysmal Sex Drive (2008), She’s Out of My League could be another 90-minute assemblage of gross-out humor, dick jokes, and unabashed homophobia. As it turns out, the latest offering from Sean Anders and John Morris is legitimately funny — far better than the trailer (and that half-assed title) would have you believe. The adorkable Jay Baruchel stars as Kirk, a hapless loser who finds himself dating bonafide hottie Molly (Alice Eve). Once you get past the film’s silly conceit — Kirk’s only "movie ugly," and personality goes a long way — you’re left with a surprisingly charming comedy. The characters are amusing and the wit is sharp. Not to mention the fact that She’s Out of My League offers a downright heartfelt message. There’s a sincerity here that feels genuine instead of just tacked-on: yeah, yeah, it’s about what’s inside that counts, but there’s more to it than that. Ignore the dreadful "jizz in my pants" scene, and the movie’s almost an old-fashioned romcom. (1:44) Elmwood, Oaks, 1000 Van Ness, SF Center. (Peitzman)

Shutter Island Director Martin Scorsese and muse du jour Leonardo DiCaprio draw from oft-filmed novelist Dennis Lehane (2003’s Mystic River, 2007’s Gone Baby Gone) for this B-movie thriller that, sadly, offers few thrills. DiCaprio’s a 1950s U.S. marshal summoned to a misty island that houses a hospital for the criminally insane, overseen by a doctor (Ben Kingsley) who believes in humane, if experimental, therapy techniques. From the get-go we suspect something’s not right with the G-man’s own mind; as he investigates the case of a missing patient, he experiences frequent flashbacks to his World War II service (during which he helped liberate a concentration camp), and has recurring visions of his spooky dead wife (Michelle Williams). Whether or not you fall for Shutter Island‘s twisty game depends on the gullibility of your own mind. Despite high-quality performances and an effective, if overwrought, tone of certain doom, Shutter Island stumbles into a third act that exposes its inherently flawed and frustrating storytelling structure. If only David Lynch had directed Shutter Island — it could’ve been a classic of mindfuckery run amok. Instead, Scorsese’s psychological drama is sapped of any mystery whatsoever by its stubbornly literal conclusion. (2:18) California, 1000 Van Ness, Sundance Kabuki. (Eddy)

A Single Man In this adaptation of Christopher Isherwood’s 1964 novel, Colin Firth plays George, a middle-aged gay expat Brit and college professor in 1962 Los Angeles. Months after the accidental death of Jim (Matthew Goode), his lover for 16 years, George still feels worse than bereft; simply waking each morning is agony. So on this particular day he has decided to end it all, first going through a series of meticulous preparations and discreet leave-takings that include teaching one last class and having supper with the onetime paramour (Julianne Moore) turned best friend who’s still stuck on him. The main problem with fashion designer turned film director Tom Ford’s first feature is that he directs it like a fashion designer, fussing over surface style and irrelevant detail in a story whose tight focus on one hard, real-world thing — grief — cries for simplicity. Not pretentious overpackaging, which encompasses the way his camera slavers over the excessively pretty likes of Nicholas Hoult as a student and Jon Kortajarena as a hustler, as if they were models selling product rather than characters, or even actors. (In fact Kortajarena is a male supermodel; the shocker is that Hoult is not, though Hugh Grant’s erstwhile About a Boy co-star is so preening here you’d never guess.) Eventually Ford stops showing off so much, and A Single Man is effective to the precise degree it lets good work by Goode, Moore and especially the reliably excellent Firth unfold without too much of his terribly artistic interference. *Sweetgrass Recorded between 2001-03 by Lucien Castaing-Taylor and Ilisa Barbash, Sweetgrass immerses us in sheep farming before taking off after a pair of latter-day cowboys on a 150-mile drive through Montana’s Absaroka-Beartooth range — a journey with deep historical roots and no practical future. As its rugged scenery beggars (but ultimately unseats) projections of the pastoral, so too do its mild sheep trigger myriad symbolic associations. Sweetgrass is finally about the relationship between farmhands and their flocks, and in this, it is notably unsentimental. During long takes of shearing and birthing, the correspondent displays of violence and tenderness, much of it erotic and seemingly reflexive, speaks to the human-animal encounter Berger eulogized in 1977. The lonesome cowboys whisper sweet nothings to the dogs and hurl fantastically mismatched streams of curses at the sheep (the absence of women being the common link). Through it all, Castaing-Taylor’s camera is an embodied presence, and hard work at that. Compared with Planet Earth‘s impossible views and spectacular displacements, Sweetgrass has its feet planted on the ground. (1:41) Lumiere, Shattuck. (Goldberg)

REP PICKS

The Female Bunch Al Adamson was the Ed Wood Jr. of the late 60s and 1970s, albeit a version without any delusions of grandeur — in it for the money, he knew his ultra-cheap films were crap. This one, titled to cash in on The Wild Bunch and made the same year (though there were no distribution takers until 1971, two years later), is closer to an unacknowledged, soporific remake of Herschell Gordon Lewis’ great ’68 She-Devils on Wheels, with the deadly dames on horseback rather than motorcycles. When Sandy (Nesa Renet) is dumped by her faithless Vegas lounge singer boyfriend — and no wonder, since she behaves like a Velcro doormat — her showgirl friend Libby (peroxide-blonde perennial Adamson star and subsequent spouse Regina Carroll) recommends she join a "club" of women on a secret ranch. They smuggle drugs, have soft-core orgies (with Mexican men and each other), abuse the local "wetbacks," and enforce a strict "no men" rule on ranch property whose violation can lead to the poor sod getting branded, dragged to death, or worse. One such unfortunate is Russ Tamblyn, who sure fell hard and fast from being third-billed in Best Picture winner West Side Story just eight years prior; another is pathetic ranch hand Lon Chaney, Jr. in one of his last roles, seeming even more pathetic than called for because he was undergoing debilitating cancer treatments at the time. The "she-devil" here is serious man-hater Grace, whose thespian Jennifer Bishop also appeared in such greats as 1970’s Bigfoot (as one of the pretty girls it keeps chained in its cave), 1974’s Impulse (imperiled by William Shatner), 1969’s The Maltese Bippy, and two Hee Haw episodes. The Female Bunch was advertised with slogans including "Hot Pants — and a Fast Draw! They Treat Their Horses Better Than Their Men!" It was partially shot at the Spahn Ranch, also home at the time to Charlie Manson and company. This grade-Z opus is preceded at the Vortex Room by the very big-budget Candy (1968), an abysmal stab at Terry Southern’s porn satire whose all-star cast included everyone from Brando and Burton to Ringo Starr, Sugar Ray Robinson, John Huston, and Anita Pallenberg. Why Muni is in such trouble

OPINION The Municipal Transportation Agency’s Web site states a goal of providing a "convenient, reliable, accessible, and safe transit system that meets the needs of all transit users" in San Francisco. I have a feeling that if you ask most Muni riders, few would use those words ("convenient," "reliable," "safe," "meeting the needs of all transit users") to describe Muni today.

Riders have been put in the untenable position of paying higher fares for less service. Yet Muni still faces a $17 million deficit (projected to grow to $55 million next year), which it proposes to close by again increasing fares and cutting services. When asked about Muni recently, Mayor Gavin Newsom pointed to a $179 million reduction in state funding as the culprit. And while no one can dispute the devastating impact of such a cut, there are a few questions that suggest that the state alone is not to blame for Muni’s troubles.

For one, we just learned that the MTA has not had a management and performance audit since 1996. Although it’s undergone a number of fiscal audits, a management audit is different; such an audit would actually evaluates Muni’s operations to determine if the system is run effectively and efficiently. How is it that an $800 million operation can go for 14 years without that type of evaluation?

Moreover, what does it say about how Muni is managed when the agency has consistently failed to control overtime costs? We just learned that Muni accounts for about half of the city’s overtime expenses. This fiscal year alone, Muni has spent $23.8 million in overtime, or 45.6 percent of the city’s total. What kind of management and operational practices allow an agency to function like this?

And why is Muni spending 9 percent of its budget ($67 million) on work orders (with other departments) for services that may or may not have much to do with its mission — including $12.2 million for the Police Department, $8.5 million for the Department of Telecommunications, and $6.9 million for the General Services Agency that runs 311? Since a quarter of the value of these work orders would suffice to wipe away its deficit, what, if anything, has Muni done about this?

And speaking of Muni’s deficit, why is it that increasing fares and reducing services seem to be the only tools in its tool box? As a number of transportation experts have suggested, there are several options that should have been on the table — raising parking fees, adding parking meters, charging for blue placards, and putting a revenue measure on the ballot, just to name a few. While some of these options may not be the answer, has Muni at least considered them? Did it consider them before proposing more fare increases and service cuts, including doubling fares for seniors, the disabled, and youth?

All this points to a more fundamental question — what about the MTA Board? Has the board provided the type of engaged and independent oversight needed to guarantee effective management? And is independent oversight even possible when all board members are appointed by one person, the mayor?

Because of these and other questions, I am proud that the Board of Supervisors unanimously approved a motion I introduced asking the budget analyst to conduct an independent management audit of the MTA. Given the timing of the budget process, the first phase of the audit will be completed by May 1, with the remainder in the summer. The audit will evaluate key areas of Muni’s operations to shed light on whether it is truly following best practices. We owe it to the ridership to face these questions head on. We no longer have the luxury to wait for the state to do the right thing.

Steve Poizner is scary!

I knew that Republicans have gotten pretty loony these days, but gubernatorial hopeful Steve Poizner was downright scary in his debate with Meg Whitman yesterday, threatening to create racial unrest and bankrupt the state in the name of being more conservative-than-thou.

He wants to deny all public services to undocumented immigrants and chided Whitman for not currently supporting Prop. 187, the 1994 measure that was struck down by the courts as unconstitutional. And after correctly saying California was “on the brink of economic collapse,” he went on promote that collapse by calling for a 10 percent reduction in sales, corporate, and income taxes, which really would bankrupt a state government that is already wrestling with a multi-billion-dollar budget deficit.

Now, I know that he’s pandering to the right-wing lunatic fringe of California, where Republicans are less than a third of voters and shrinking, and they’re all riled up these days from drinking too much Fox-brewed tea. But damn, this guy has really lost his mind.

It’s not any big surprise that Gavin Newsom is officially running for lieutenant governor; we all knew that was in the cards. Newsom’s downtown allies don’t want him running, because he might win — which would mean a vacancy in the mayor’s office. But it’s really all about Newsom, and he doesn’t want to be termed out with nowhere to go.


Calitics makes the point that


In many ways, this race will showcase the future leadership of California Democrats. The winner of the primary will go on to defeat Abel Maldonado and will be a top contender to be the next governor, whether they succeed Jerry Brown or (god forbid) Meg Whitman. It’s to the benefit of Democrats and progressives that this race be issue-oriented, and free of the unfortunate personal attacks that would undermine all the candidates involved.


And Newsom loves the idea of being showcased as the future leader of California Democrats.


Newsom got a big bounce the moment he announced, when state Sen. Dean Florez, one of two other Democratic candidates for the office, dropped out and endorsed Newsom.


That leaves just Newsom and Janice Hahn, a Los Angeles City Council member who’s got an aggressive campaign (featuring Garry South, the asshole political consultant who used to work for Newsom).


Newsom starts off with a major lead; all the money he spent campaigning for governor gave him significant name recognition, and in a Democratic primary for a low-profile office, that makes a lot of difference. And his likely opponent in November is Abel Maldonado, a not-terribly-appealing Republican.


So the talk in San Francisco is all about who becomes the next mayor if Newsom wins — and already, the Newsom strategists are trying to figure out how to prevent the progressive district-elected board from appointing his replacement. The latest strategy: A Charter amendment establishing that a vacancy in the Mayor’s Office has to be filled in a special election.


Hard to argue against that — except that the special election would be in the spring of 2011, and the general election would be that fall, meaning two expensive elections (one of them guaranteed to have low turnout) in the course of 11 months.


There’s no way Newsom’s getting six votes on this board for his idea, which means he’s going to have to raise the money to gather 47,000 signatures. And if he does, the supervisors ought to respond with their own Charter amendment — establishing that vacancies on the Board of Supervisors (now filled by a mayoral appointment) also require a special election. That’s only fair.


And while Newsom and his allies talk about how unfair it is to have district supervisors, some of whom were elected with as few as 10,000 votes, decide on the next mayor, it’s worth thinking through what a special election for mayor would look like. For starters, a lot of people would probably run — and the results would be utterly unpredictable. Suppose everyone who really wants to be mayor jumped in: Leland Yee, Dennis Herrera, Aaron Peskin, Ross Mirkarimi, Bevan Dufty, maybe Michela Alioto-Pier, maybe Sean Elsbernd, maybe even Mark Leno … and the turnout will be ultra-low, and, well, the next mayor’s going to be elected with a remarkably small number of votes.


Assume a turnout of 100,000 — high for a special election. And assume seven candidates (there would probably be a lot more). That means the winner would be unlikely to have more than 20,000 first-place votes.


If it’s a ranked-choice voting situation, any of the above could pull it off. If it’s a simple plurality, hey: someone like Chris Daly, who has a small but highly devoted constituency, would have as good a chance as anyone.


The bottom line is that a special election doesn’t guarantee anything — in fact, it could turn out to be downtown’s worst nightmare.


Here’s the letter Newsom sent to potential supporters:


I didn’t come to this decision easily, but, after a great deal of consultation with my family, constituents and supporters, I believe that the best way for me to serve is by taking all of the many things that are right about California and applying them to fixing what’s wrong in Sacramento.  


The issues I fought for when I ran for Governor last year haven’t changed: our state still faces a massive budget crisis, painful unemployment, and rising student fees that threaten the stability and accessibility of our University system.  Too many Californians lack access to quality health care and too many schools are overcrowded and underfunded.


But, despite our challenges, I will always believe in California – the dynamism of its past and the promise of its future.  I’m also convinced that those of us who love this state have both an obligation and the capacity now to reform it and make it better. To do that, we need to embrace a new way of doing things in Sacramento and we need new leaders who are willing to stand up and change state government.


I’m proud that I have the support of Speaker Nancy Pelosi, Senate President Darrell Steinberg, Assembly Speaker John Perez, Sacramento Mayor Kevin Johnson, United Farm Workers co-founder Delores Huerta and California Nurses and teachers and I hope I can count on your support too.

Steampunk convention tinkers mightily

Steampunk has been described as a “step sideways in time.” It’s certainly not a regressive subculture- one peek at the kinds of clockwork corsetry and hydraulics operated moving machines that steampunk tinkerers fashion will convince you of that- but rather, a rethinking of where technology could have led us. It’s a topic that’s figuring prominently in the minds of many these days, which means this year’s New Albion Steampunk Exhibition (begins Fri/12) promises to be more whiz-bang than ever.

Picture, if you will, a mass of punks and nonconventional individuals in Victorian garb and laboriously created wings, monocles, wrist weaponry and whatnot, all milling about to waltz music in a very conventional hotel convention space. Surely, unsuspecting squares of Emeryville will be freaked.

Three tracks will guide tinkerers through the exhibition; one for DIY-ers, one for those with an ear for scholarly discussions of steampunk and another that focuses on the give-and-take of expert panel discussions on the culture. Participants can also pick and choose among the bounty- after all, who could miss discussions on steampunk philosophy featuring the movement’s great literati, James Blaylock? Or a rundown of the history of man powered submarines, classes on leather working, the regal history of steampunk, a panel who will dissect and illuminate “steampunk garb for life on a budget,” a look at the observatory as “science temple”, a museum of curiousities? Impossible, you must go to all.

After the learning, ballrooms galas and drink and meets will keep participants busy, just like at any other convention. Well, except for the fact that this gala will include prizes for the “most workable wearable invention” and meet and greets will center around self propelled three story Victorian houses and feature drinks served by robots.

Just a simple step sideways, really.

Guardian reporter’s inside story on arrested protesters

I thought I was keeping a safe distance, observing Day of Action protesters as they went onto Interstate 880 to block traffic rather than participating, until a line of riot cops came barreling towards where I stood by the side of a freeway offramp. But my flight instinct took over, and I found myself running along northbound 880 with my notebook and pen still in my hands. What had been an impressive but otherwise peaceful protest was taking a surreal turn. But maybe I should start from the beginning.

As a recent UC Berkeley grad, I had been on campus many times in the last few months, invited by friends to support the occupations and protests that were fueling an extraordinary movement to defend public education. So I was excited to go out on March 4th to cover the Day of Action in the East Bay. This was a new experience for me. Like any good Berkeley grad, I’ve participated in my share of protests, but now I was a Bay Guardian news intern and this was the first time I was going out as a reporter.

There was a lot to be impressed with that day. In Berkeley, activists had succeeded in creating a broad coalition made up of graduate and undergraduate students, faculty, union members, lecturers, and campus workers and staff. These constituencies were well-represented Thursday morning.

Berkeley organizers were also working to expand their movement beyond the university. Callie Maidhof, a graduate student in anthropology, told me that March 4th is the “first attempt to organize beyond a single system, to organize across California, across the public education systems, and across the nation.”

On the four and a half mile march from Berkeley to downtown Oakland, there was plenty of evidence that they were succeeding. As the Berkeley contingent marched down Telegraph Ave., it was joined by middle school and high school students who brought their own concerns about teacher layoffs and program cuts.

At the rally in Oakland, I spoke to high school students who had walked out of their schools to participate. Sophomore Sienee Dakina from Oakland’s Envision Academy told me that her school lost three teachers because of budget cuts. “We feel like it’s not right,” Dakina said. “We’re losing our teachers.” Ninth graders Victoria Romero and Andrea Barba from Life Academy told me that they were protesting so that the school district would “not take our dreams away.”

When the rally ended, some people were headed to San Francisco to take part in the big rally at Civic Center. I knew that there would already be Guardian reporters there, so I decided to stay in Oakland for what was being billed as an after-protest dance party and “snake march.”

The dance party started around 4:30 with a couple hundred people taking Broadway accompanied by a mobile sound system, black flags, and large banners that declared “We Have Decided Not to Die” and “Occupy Everything.” For the first time that day, I saw riot cops in full force. I read these as signs that something dramatic was probably in store. The dance party wound its way through downtown Oakland, stopping in front of the UC Office of the President before heading towards West Oakland.

I was at the back of the march, talking to an Oakland teacher who was telling me about layoffs at his school, when the police started warning the crowd that they could face arrest. I fell behind and was playing catch-up as a group of around 150 people took to the freeway. I decided to stick by the offramp and watched as a bicyclist, who appeared to be riding on the freeway away from the march, got violently tackled by a fast-moving line of cops.

It was at this point that another line of cops started up the offramp and I fled up the freeway. An officer on a motorcycle yelled at me to continue and join the protesters or face arrest. I ran to catch up with the crowd, which was in chaos as the police approached. (I later learned that, in the chaos, a local high school student fell off the elevated highway and was taken to Highland Hospital with serious injuries.) I saw two kids – perhaps as young as 12 or 13 – trying to get away on skateboards. I was with a cluster of journalists as a line of cops and a blur of batons fell upon a group on the far side of the southbound lanes. We retreated to the dividing wall, me still clutching my pen and notebook, holding my hands in the air.

We were ordered to lay on the ground. My pen was still out so I continued taking notes. An officer noticed me and ordered me up. I explained that I was a reporter and offered to show him proof of my affiliation with the Guardian. “But you’re on a freeway,” he said. “You’re under arrest.” He did help me secure my notes and camera.

I was handcuffed and ordered to kneel on the side of the highway with the protesters, next to a friend from Berkeley, a graduate student at the journalism school. We knelt for hours waiting for the buses that would take us to Glenn Dyer jail in Oakland and Santa Rita jail in Dublin. A handful of stranded motorists cheered, presumably for the protesters, and in one of the lofts next to the freeway, a resident had posted a sign that said “FUCK U Protesters.”

I was sent to Santa Rita with around 100 of those arrested on the freeway. We were informed that we would be charged with misdemeanors and released, but it was clear that our numbers had overwhelmed the jail’s systems. Deputies told us that we would be in there for 10 hours. Ten hours turned into 20, most of that time spent in a cold concrete cell, seven feet long and seven feet wide, with 14 other inmates. There wasn’t room for all of us to lie down at the same time. The fluorescent lights were kept on all night, and I was disoriented, groggy.

The sheriff’s deputies joked about IEDs and half-heartedly threatened us with prison clichés. An agent with U.S. Immigration and Customs Enforcement visited my cell and questioned me and another person of color, asking us for our names and where we were born. My cell mates, worried about the possibility that an undocumented student had been arrested, discussed whether we should refuse to answer their questions. An inmate in a nearby cell hurled obscenities at the “protesters.” But most of the other inmates were merely curious. A few held up their fists in solidarity as they were led past our cell.

I shared cells with a diverse group of people, some I had known for years: a teacher’s aid, a Berkeley freshman computer science major, a veteran, an older man who called himself a communist, and a handful of community college students from Modesto. There were a number of other journalists: two stringers working for Democracy Now!, a reporter from the Daily Californian, and a friend who was covering the protest for Indybay.org. I had seen other journalists with big video rigs on the freeway, but one of the other arrestees told me that they had been allowed to leave.

We passed the time as best we could. The Berkeley computer science major taught us how to fold origami cranes. One of the other reporters gave an impromptu teach-in about some Bay Area residents imprisoned in Iran. We took advantage of the concrete cell’s unique acoustic properties by humming harmonies. A few cells over, the women agitated for food and we got bologna sandwiches and a strange powdered juice that tasted like the color yellow. Mostly, we tried to sleep, in fetal positions, sitting up, or curled around the toilet using our arms, shoes, and rolls of TP for pillows.

There were also discussions about the movement: how to make it broader, how best to organize and make decisions, and what should come next. It was clear to me that many of the people I was with did not know that they would end up on a freeway, but if there were any regrets, no one in my cell let that on. One man commented that the movement was getting bigger – earlier protests had resulted in dozens of arrests, but this one had 150 people taking a freeway. Another said that only the movement “intellectuals” were taking militant action. A community college student objected to that point. Earlier, he had joked about the $6 increase in his fees, but now he spoke bitterly and passionately about how he considered himself working class and not an intellectual. The budget cuts had made him feel that a quality education at a UC was getting further from his grasp.

I was not released until around 4 p.m. on Friday, charged with two misdemeanors – unlawful assembly and obstructing a public place – and ordered to appear in court April 5. Outside the jail, a small crowd of supporters had been gathered all day and it did not take long to find a familiar face and a ride back home.

A friend who had worked through the night to rally support and secure attorneys told me that a lot of students were upset about what had happened. They were critical about what they called a lack of planning and angry that protesters had been led into an action they did not fully understand and did not fully prepare for.

But the freeway action also showed how far the movement has come. Resistance to the budget cuts has spilled out of the universities and gotten bigger, broader, and, yes, perhaps more foolhardy. From my vantage point on that elevated highway, the movement has definitely upped the ante and more and more people are calling the bet.

Newsom’s Orwellian doublespeak on city layoffs

One of the things that irritates people most about Mayor Gavin Newsom is his Orwellian doublespeak, in which he makes claims that conflict with his actions, and that was on vivid display with his recent decision to lay off 15,000 city workers and then hire most of them back for shorter workweeks.

These are frontline workers (managers, cops, and firefighters were excluded) who will either be fired or take a 6.25 percent pay cut – while the public will see a rollback in the hours devoted to providing city services – but Newsom’s press release claims that he’s actually helping both the workers and the public.

“Mayor Newsom used his YouTube update this week to discuss the City’s budget and his plan to save thousands of city jobs and services by offering 37.5 hour part time positions to most city employees. This proposal will allow the City to maintain services for residents, while saving the City an estimated $50 million. San Francisco faces a projected $522 million budget deficit for the 2010-11 fiscal year.” the press release, which was sent out on Saturday (presumably so the media ignores it), begins.

As the Chronicle reported that day, none of the affected employees are happy about this “offer” they can’t refuse, and their unions are even talking about suing the city. As for this plan to “maintain services,” that’s based simply on Newsom’s demand that city employees – who, because of the layoffs in previous years, are often already doing several people’s jobs – do 40 hours of work in 37.5 hours.

Now, this reduced workweek plan might not be so terrible if Newsom had worked on it with the unions, made deeper cuts to senior management and his taxpayer-paid political team in recent years, coupled it with a push to try to increase local taxes, and been honest about its impact to city services and the local economy.

Instead, we hear that we must burn the village in order to save it, which was dubbed the “enlightened approach” in the press release (which failed to mention that Newsom plans to not rehire an unspecified number of the employees he’s firing). “The point is to keep people employed and to keep their benefits,” Big Brother Newsom said in the press release.

Later in the release, Newsom goes on to laud Thursday’s Day of Action events, in which speaker after speaker called for increased taxes on wealthy corporations and individuals in order to prevent continued cuts to the public education system – despite the fact that Newsom has been the single biggest obstacle in San Francisco to such tax increases. “They’re shutting down opportunities. Its [sic] impacted faculty, its [sic] impacted morale, and it’s going to devastate the economy of the state unless we wake up and say enough’s enough,” Newsom said, sounding like the sympathetic populist instead the mayor who has proudly touted the fact that his budgets haven’t raised taxes, relying entirely on cuts.

Big Brother couldn’t have said it better himself.

Zaccho Dance keeps it in the family

Thirty years of surviving and thriving in an area as competitive as dance, and twenty year of community involvement is more than enough of a reason for a party. Let’s say a big gala with invited donors who can help balance the budget? A retrospective of what has gone well? Nope. That’s not how Joanna Haigood’s head works. For her, it’s a reason for “Family Day,” an open house for the community with classes for the youngest and those a little stiff around the edges. So how about Movement and Storytelling for kids, hip-hop for teens, a Dance Work Out for a sedentary parent, and Circus Art for grandma. She won’t swing from the trapeze, but her spirit will get a boost. Each 45-minute class starts on the hour, and food and refreshments are provided.

Making the protests count

It was wonderful to see so many people all over the state taking to the streets to protest cuts in education and public services. The rally at San Francisco’s Civic Center wasn’t just young radical agitators, either — most of the people there were parents with kids, families, people who are just fed up with the threats to the future of this state and don’t want to take it any more.


And now that the press and public and maybe even the elected officials are focused on the issue, it’s time to move to the next step. Politicians can talk all they want about “standing with the families” and supporting education, but in the end, there’s only one way to adequately fund K-12 and higher education in California. And that’s to raise taxes.


You can talk about waste all you want, and there’s certainly waste at the University of California. But we’re looking at a need that runs into the billions, multiple billions, tens of billions — and eliminating a few million bucks of waste here and there isn’t going to solve the problem.


You’re not going to solve it by reallocating the state’s budget money, either, since there’s no single large pot of cash that can be taken and given to the schools without devastating another necessary public service. The only real possibility is the prison system, a financial sink hole if ever there were one — but again: You can’t just cut prison spending by eliminating services to prisoners. They get so little as it is — and the federal courts won’t allow any reductions in health care and the state’s already under court order to reduce overcrowding.


You could probably solve half of the schools’ fiscal problems by releasing from prison every single inmate serving time for a drug offense; that’s the kind of dramatic steps we’re talking about. And if anyone wants to launch a political campaign to let 30,000 prisoners free tomorrow, I’m with you.


But it’s not going to happen, not in this climate. So the only real option is to get more revenue. That means raising taxes at the state level, repealing Prop. 13 to allow local property tax hikes, or raising taxes at the city level.


And here’s who the protesters need to be targeting:


1. The governor. Arnold Schwarzenegger not only refuses to allow new taxes as part of the budget, he vetoed Sen. Mark Leno’s bill that would have allowed local government to raise its own car taxes. He’s at (916)-445-2841.


2. The Republican leadership of the state Legislature. These folks go into the budget talks with the power of a minority that can block the two-thirds vote required for tax hikes, and they’ve both signed “no new taxes” pledges. These two people are among the single largest reason that the California school are facing such huge cuts. Assemblymember Martin Garrick,  916-319-2074. Senator Dennis Hollingsworth, (916) 651-4036.


3. Attorney General Jerry Brown. He’s running for governor as the Democratic candidate, and he has already announced that he won’t raise taxes and that Prop. 13 is untouchable. He won’t even support Assemblymember Tom Ammiano’s bill to legalize and tax marijuana. He needs to hear from his constituents that those positions won’t fly. (916) 322-3360


4. The mayor of San Francisco. Gavin Newsom is happy to announce that he supports education funding, but he’s never come forward with a single significant new tax increase for the city. Local taxes could be split between the general fund and the schools, and the progressives on the Board of Supervisors are looking for revenue options. Call the mayor and tell him: If Sacramento won’t raise taxes to educate our kids, we’d like to do it at home, in San Francisco. 415-554-6141.


5. Any state or local official who claims to support the schools but won’t publicly endorse and work for higher taxes. Folks, there’s no other way out of this.


And at the next rally, let’s chant: Repeal Prop. 13, Now! Tax the rich in San Francisco — Now!

MUNI driver: luck, not system, saved my family

MUNI bus driver Charles Washington says it was luck that won his family a reprieve from a federal deportation order. His Australian bride Tracey, who he married in Reno last April, and her 13-year-old son were served deportation orders after the boy got into a schoolyard fight and a police officer wrote him up with three felony charges. Under the city’s current policy, felony charges against undocumented youth triggers an immediate referral to ICE before the youth can prove their innocence.

After the hearing, the juvenile probation department dropped language from its policy that advocates say could lead to racial profiling, but JPD Chief William Sifferman said the department cann’t allow kids due process for fear of being accused of harboring and transporting aliens.

Washington’s family won a reprieve after the media learned of their plight, an outcome Charles puts down to luck, not evidence that the system is working. He believes the nightmare his family is going through proves that the city’s policy towards immigrant youth isn’t working. And he wants those responsible for setting that policy to take responsibility and fix what’s broken,  not pass the buck by trying to hide behind federal laws they claim prevent them from fixing their own policy.

“The problem with the policy is that is doesn’t allow for due process,” Washington said during a March 4 hearing on the city’s policy which Mayor Gavin Newsom ordered in 2008.”The policy is based upon the original charges that a police officer made, a  field officer who has to make a quick decison based upon a couple of known facts,” Washington said. “Kids get treated as if they are guilty before they are proven innocent. There has to be a better way for the system to work.”

Washington doesn’t blame the city’s police or probation officers for his stepson getting referred to the feds before he could prove he was innocent of felony-level charges.

Gabe Calvillo, president of the city’s probation officers union, congratulated the Washington family on their reprieve, but repeated concerns that giving kids their day in court would put his members at risk.

And Washington does not blame city workers for the fact that federal immigration agents used his stepson as bait to get his wife to come in to their Sansome Street office where they handed her and her son deportation orders and slapped an electronic monitoring device on her ankle–a device she is still wearing to this day.

 Tracey Washington demonstrates the device that the feds are forcing her to wear, making her feel like a “murderer,” even though the couple say federal contractors gave them misinformation about when to apply for a green card, after she got married to  Charles Washington while she and her two sons were here on a visa waiver.

As a city worker, Washington gets that these city workers were simply following orders. But as a husband, father and US citizen who is still fighting to keep his family intact, he believes that those responsible for the policy that led to this nightmarish sequence of events are hiding behind claims that their hands are tied by federal law. And he wants them to get off their hands and back to the drawing board, so other families don’t have to go through what his family just experienced.

And unlike many families that feel they were unnecessarily ripped apart by the city’s policy towards immigrant kids, Washington can articulate his concerns without fear of being deported himself.

“It’s unbelievable how any family could have been put in that position,” Washington said, recalling how his son landed in ICE’s hands, after a SFPD officer wrote him up for three felony charges, following a schoolyard fight over 46 cents.

When an SFPD officer charges a juvenile with a felony, juvenile probation is required to refer the kid to US Immigration and Customs Enforcement (ICE), if they suspect the youth is here without legal documentation.

Once Washington’s stepson was referred to ICE, under a policy that Mayor Gavin Newsom ordered in 2008, the feds ordered him and his mother deported, without waiting to see if local courts actually find the boy guilty of any felony charges.

It was only when Washington went public with his family’s nightmare and the media started making calls that ICE backed off.

But while it was the city’s flawed policy that landed the Washingtons in this dilemma, the Mayor’s Office did not offer to try and help. Instead, the Mayor’s office claimed that their case proves that Newsom’s policy is “not draconian.” (You can read Newsom’s full statement at the end of this post.)

“The Mayor’s Office could have contacted me, tracked me down,” Washington said. “But they just sat back and waited to jump on the band wagon, whichever way it went.”

Mayoral spokesperson Tony Winnicker said the Mayor’s Office was sympathetic to the family’s plight but could see no reason to get involved in what he described as “a federal immigration matter.”

But Washington notes that it was Newsom’s policy that led to his stepson being referred to ICE, and the feds would have deported his family this week, if they hadn’t gone public with their case,a step most immigrant families are afraid to take.

“The bottom line is that we got lucky,” Washington said. “How many families wouldn’t know what to do in this situation? When I spoke at the press conference at the Asian Law Caucus,  I didn’t know what to do either. What if the Asian Law Caucus had been too busy, or the media hadn’t come to the press conference? Does everybody have to contact a lawyer. Our story shows that the system failed, and that it was luck that saved us.”

While folks are acting as if the Washingtons’ problems are over, the family still faces huge financial and legal challenges.

“For the time being, we’ve had a huge burden lifted off of us, but the next huge problem is that we are bing requested to have one-way plane tickets ready for the first part of April, though we are not being asked to leave now until May 4, that’s several thousand dollars that we have to lose,” Washington said, noting that it will cost over $4,000 to apply for green cards.
“Meanwhile, It looks like everyone wants to point the finger at someone else instead of focusing on the fact that there is a problem.”

Washington made his comments after a hearing that Sup. David Campos called to determine why the Juvenile Probation department hasn’t implemented an amendment that Campos introduced in 2009 to address the Catch 22 situation that’s  hidden within Newsom’s current policy and that ensnared the Washingtons’ kid.

Campos’ amendment instructed probation officers to wait until kids have had their day in court before referring them to ICE. But Mayor Newsom said he will ignore the amendment, and JPD Chief Sifferman has refused to implement it.

Either way, Campos’ March 4 hearing offered a rare insight into the, some would say, dysfunctional dynamics within the city’s juvenile justice department since it came under the microscope of US Attorney Joe Russoniello in 2008.

A Bush appointee, Russoniello has been ideologically opposed to the concept of sanctuary ever since the city enacted its City of Refuge ordinance in the 1980s, when he was first US Attorney for Northern California.

After Kevin Ryan was fired as US Attorney in 2006 and hired as Newsom’s director of criminal justice in 2007, Russoniello resumed his post as top federal prosecutor, a position of power that let him launch a federal Grand Jury investigation in 2008 to determine if JPD’s former practices violated federal law.

Ryan has since resigned from the Mayor’s Office, and the Obama adminstration is vetting Russoniello’s replacement, but the City claims it can’t give immigrant kids their day in court for fear of federal retaliation. And some believe the unresolved tension between the city’s sanctuary policy and the federal immigration laws will continue, unless national immigration reform occurs.

Juvenile Probation Department Chief William Sifferman said today that his department is eliminating language from its juvenile immigrant policy that could be an invitation to racial profiling.

JPD Chief William Sifferman told Campos that his department looked into Campos’ amendment, which directs JPD to modify its policies and practices to the “extent permitted by federal law”‘and concluded that it cannot modify them.

Sifferman recalled what happened when JPD used to return immigrant youth to their country of origin or place them in group homes, with no notification to ICE.

“Many of these youth were arrested for selling crack cocaine in the Tenderloin, were placed in group homes, ran away, were rearrested, selling drugs again,” Sifferman testified.

He recalled how JPD officers were interrogated and threatened with arrest by federal agents who intercepted them at Houston airport as they were accompanying minors to Honduras. And that Russoniello subsequently convened a Grand Jury to investigate JPD’s actions.

“That investigation continues to this day,” Sifferman said. “The department’s current policy was adpoted becoasue of these concerns.”

“Until a court rules otherwise, the department must conclude that [federal] law would not allow the city to change its policy,” Sifferman said.

He said probation officers are trained not to directly question juveniles or their parents about their immigration status. And hee noted “a marked reduction” in the number of unaccompanied Honduran minors who have been arrested for selling crack cocaine.

“We believe our policy has significantly reversed a 15-year trend in the city’s history,” he said.

Sifferman said he did not receive Campos’ request for time estimate information until 48 hours before the March 4 hearing, though Campos said he made his request weeks ago.

But he offered some statistics, including the fact that “since July 2008, JPD has released 107 unduplicated youth to ICE, 125 times.”

“This means that 17 were referred to ICE twice, that they returned to country of origin, then reoffended,” Sifferman explained.

He also noted that 92 percent of the youth are released to ICE after a felony finding.

“Only a small number are released to ICE without having determined if they had committed a felony,” Sifferman said.

The monthly average of kids referred to ICE for the first four months of the city’s new policy was ten, Sifferman said.

“And for the past 16 months, it’s been five,” he said. “We attribute this decline to undocumented Honduran youth no longer returning to the Tenderloin to sell crack with the same frequency.”

But he claimed that while there has been a reduction in releases to ICE, there had been no measurable decline in probation officer’s case or work load.

‘They continue to supervise kids who have not been referred to ICE,” he said.

“We have dedicated none of our resources to working with ICE,” he added.

Contact with ICE is limited to fax transmissions, follow-up phone calls, and follow-up responses, Sifferman said.

“Probation officers do not arrest or detain youth based on their undocumented status nor do they assist in taking youth into ICE custody,” Sifferman said. “We must always recognize the public safety impliations of our policy.”

Asked what kind of resources JPD spends on this contact, Sifferman said, “De minimus.”

Pressed  for more details,  Sifferman said, “It’s difficult to estimate given that our staffing level functions are ministerial—a fax being sent a record placed in a file, a phone call about a potential release date. We haven’t done a time study.”

Campos noted that unlike JPD’s former policy, the amendment he enacted last fall does not call for prior policing and actual transport of youth across the country. But Sifferman countered that if youth are released back into the community, JPD could be aked to transport them “to various locales.”

Campos questioned Sifferman as to the origin of language in Newsom’s current policy that immigrant advocates believe could lead to racial profiling (language that, as the Guardian learned today, has now been deleted from the policy).

“In determining whether there is reasonable suspicion that youth is undocumented, one of the criteria listed in the policy says, ‘presence of undocumented persons, ‘ but how would you know when a person is undocumented?” Campos asked.

“There could be information in the arresting report describing the conditions,” Sifferman suggested.

“How did you decide to include this language in the policy?” Campos asked.

“It was based on research and advice we received from the City Attorney’s office,” Sifferman said. “The entire policy is based on review and approval of the City Attorney’s office.”

“Can you see how something as open-ended as this could lead to racial profiling?” Campos asked.

‘It could, it requires vigilant oversight, if that criterion was taken alone, we’d have  a problem wth that,” Sifferman said.

Sup. Eric Mar said he was “very upset,” that Sifferman did not have the cost estimates available.
Mar also voiced concerns that the policy sounded “like a justification for racial profiling.”

“I really respect you, but it sure sounds like you’re flying in the face of San Francicso values when you are not implementing a policy to protect due process,” Mar said.

“I disagree that we have been intentionally stalling,” said Sifferman, who has been hit with budget cuts and staffing reductions in the past couple of years like other department heads.

Campos took issue with Sifferman citing Title 8, Section 1373 of the US code as justification for not implementing his policy amendment.

That section of the US code states that, “Notwithstanding any other provision of Federal, State, or local law, a Federal, State, or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual. “

“Can you point to a section of the federal law that requires you to report?” Campos said
“No, I can’t,” Sifferman said.

But Sifferman subsequently noted  that there is a prohibition against “transporting and harboring any person known to be undocumented,” a position that leaves JPD officers feeling vulnerable given that the department has received three federal Granf Jury subpoenas related to JPD’s previous policy towards juveniles.

During public comment, UC Davis Law Professor Bill Ong Hing addressed the fact that a bunch of misinformation continues to swirl around the city’s immigrant juvenile policy.

“I would encourage the Board, Chief Sifferman, the Mayor’s Office and City Attorney’s office to sit down together,” Hing said. “A lot of misinformation is floating around.”

Hing noted that there is nothing in the Campos amendment that prohibits reporting kids to ICE.

“But you do not have to volunteer information to them, if it’s not required,” Hing said.

“The vast majority of jurisdictions don’t contact ICE [before kids have day in court], they recognize that’s not good policing, ” Hing continued. “Under the rules of federalism, there is nothing that prohibits this ordinance.”

“And there has never been a prosecution of a city worker [for following a city’s sanctuary policy], and [a prosecution of a city worker for that] wouldn’t be authorized by the Obama admininstration,” Hing claimed.

He also said that a confidential memo that Mayor Newsom leaked to the Chronicle was ‘laughable”.

“It exagerrates the likelihood of a successfully overruling the sanctuary ordinance,” Hing said.

Hing concluded that City Attorney approved language in Newsom’s current policy, “is a complete inviation for racial profiling.”

City Attorney spokesperson Matt Dorsey responded forcefully to these accusations.

“Racial profiling is illegal, and something we take very seriously,” Dorsey wrote in an email.” Part of the City Attorney’s duty is to advise against illegal conduct. If a client department informs us that a policy could risk illegality, we will work with our clients to make sure laws aren’t broken, and that no one’s rights are violated. That’s a job lawyers do every day.  And that’s especially true here, where the matter involves litigation, threats of litigation, and a federal criminal investigation.”

And today, JPD decided to eliminate the language that was triggering racial profiling concerns.

Meanwhile, mayoral spokesperson Tony Winnicker noted that of the 125 reports to ICE since July 2008, 97 percent were for felony arrests, and the other 3 percent were “misdemeanors with priors.”

Winnicker also emailed a statement from Newsom that reads as follows:

“I have long supported our sanctuary policy and a range of policies and programs designed to assist our immigrant community. I believe San Francisco continues to be an international leader with our efforts to protect immigrants in our community. However, the sanctuary ordinance as originally conceived and adopted was designed to protect all residents of our city, not as a shield for felons and criminal behavior. I will not put City staff, our sanctuary city policy and thousands of residents at risk to shield felony criminal behavior by a few. Immigration and Customs enforcement is a federal responsibility. San Francisco cannot be the arbiter of immigration cases that take place within the City. That’s why many other counties in California have a similar policy of reporting suspected juvenile felons to Immigration and Customs Enforcement at the booking stage. The recent example of the Washington family validates that our current policy is appropriate. Juvenile Probation officials report undocumented felony arrests to Immigration & Customs Enforcement, and Immigration & Customs Enforcement officials determine the appropriate response. In this case, once President Obama’s Immigration and Customs Enforcement office became aware of the exceptional circumstances around the case, they took commendable action to ensure that the young boy and his family were given time to resolve their residency status.San Francisco’s Sanctuary Ordinance continues to strike the appropriate balance between offering a welcoming hand to our immigrant community and protecting the public safety of law-abiding residents of our City.”

That’s a fine statement, and I’m sure the mayor cares about youth, whatever their nationality and immigration status. But  immigrant youth still face a  Catch 22 trap within his policy that has led kids who haven’t committed felonies being referred to ICE for deporation. The question now becomes, can a miracle happen? Will everyone involved–at the city and federal level–sit down and hash out an equitable solution? Will heads of other city departments acknowledge their role in this process or will Sifferman be hung out to dry all on his lonesome? And will a bunch more kids get thrown under the bus before we as a nation find our way towards a saner and more equitable immigration process? Stay tuned.

Young people protest school cuts

The scene was relatively quiet around 1:45 p.m. on March 4—just another sunny afternoon in the Mission District. Fifteen minutes later, things got much louder. Hundreds of Mission High students, accompanied by faculty and staff, poured out upon Dolores Street near the intersection of 18th, banging drums, blowing whistles, chanting, and holding handmade signs reading “Stop Crippling Public Education,” and “DREAM: Act Now.” Cars halted at the intersection honked in support, and the marching students, invariably stoked to have left school almost an hour early, grew louder in response.

It was one of the first actions in the Mission in conjunction with dozens of others across the state in protest against massive budget cuts in public education. The Mission High marchers continued their march south along Valencia Street, eventually converging with numerous other school and civic groups at the 24th and Mission BART station. In preview of the boisterousness that was to follow, a group of students from Cupertino was chanting, “You say cut backs, we say fuck that!”

One of them, Lucas Ho, told me that with the massive budget cuts, “The chances for student success are being limited,” citing rollbacks in honor programs and not hiring tutors. Another student who only gave her name as Stacey, came with about 30 other students from Balboa High School. “Our education is important,” she said emphatically, before our conversation was cut short by more chanting and drumming.

Particularly heartening were the large number of enthusiastic elementary school students, who at many points during the day’s rallies, seemed to be leading the charge. The San Francisco Community School, in particular, seemed to come armed with a number of assertive youngsters, one of whom on the verge of yelling themselves hoarse with crowd-hyping chants over a megaphone.

Fifth-grader Deontay Harper stood by holding a large banner. “We’re protesting for justice and to save our teachers,” he told me with surprising erudition. Without proper funding, “it’s gonna be harder for us to learn.” SF Community School 4th and 5th grade teacher Robin Yorkey concurred. The budget cuts “are going to ruin us,” she told me over the din. “They’re going to make class size huge, and we’re incredibly concerned.” In the background, the aforementioned pint-sized Eugene Debs on the megaphone engaged in the classic call-and-response, “What do we want? Justice! When do we want it? Now!”

Across the street, 11th grader Moneace Smith came with fellow students and teachers from June Jordan School for Equity. “It is our future money—we need that,” she told me, showing a level of recognition of the cuts’ long-term impact. “We want our education. We want to go to college.”

SF State students march

San Francisco State University added pageantry to the Day of Action protest, one of the many schools from around the Bay Area from Kindergarten to Ph.D that united on the steps of San Francisco City Hall yesterday.

Students, faculty and staff painted their faces, wore colorful t-shirts and paraded 10-feet high puppets depicting a skull-faced grad, a crying queen and a fossilized dinosaur; each representing greedy politics and the killing of education.

SF State students started the day with blocking traffic on Holloway and 19th streets, an echo of the 1968 student strike when SF State students did the same thing to protest civil rights. Police were ordered to clear the protesters out of the streets, but students continued on the sidewalk before merging with several other organized demonstrations in Malcolm X plaza.

Hundreds of students filled the open-air plaza to dance to music, hear spoken word poetry and chant. By 3:30 p.m. the festivities moved to City Hall where university students marched along side elementary, middle and high school students. “We’re in solidarity with everyone in this protest. Not centralized but many coming together to send one message. We have elementary students protesting, for the first time ever all facets of education are joining up. It’s beautiful and it’s healthy,” Phil Lassky, an Ethnic Studies teacher.

Empowerment was the feeling in the air. Many who participated had stories about how budget cuts have kept them from graduating, sitting on the floor in classrooms and not receiving their financial aid checks. “They have forgotten about us. Here we are paying for the bank’s debt and we get our budgets cut? Time for this to stop,” said Andrea Thomas a senior at SF State. Some teachers were uncertain if they’ll have work in the fall, and some were certain they would have no classes to teach.

Not all on the Gator campus were eager to spray paint a sign. Some students said they thought the Day of Action was futile and contradictory. “Ditching class is a hypocritical message that goes against what we are all trying to do,” said Travis Northup, SF State sophomore. “Instead of posters with vague statements we should be trying to find solutions that are reasonable.”

But most of the campus community seemed down with the cause. Ramon Castellblanch, health professor and California Faculty Association president for the university, was one of the leading protest organizers for SF State. Planning had begun back in January and he was astounded by the number of students willing to volunteer. Speaking on those who have chosen not to join in, Castellblanch remarked, “They need to decide the best way to spend their time, usually it’s being in the classroom, other times it’s not. If something doesn’t happen, there may not be any classes left to be in.”

Stiglitz: The Dangers of Deficit Reduction

Here is our monthly installment of Joseph E. Stiglitz’s Unconventional Economic Wisdom column from the Project Syndicate news series. NEW YORK – A wave of fiscal austerity is rushing over Europe and America. The magnitude of budget deficits – like the magnitude of the downturn – has taken many by surprise. But despite protests by the yesterday’s proponents of deregulation, who would like the government to remain passive, most economists believe that government spending has made a difference, helping to avert another Great Depression.

Most economists also agree that it is a mistake to look at only one side of a balance sheet (whether for the public or private sector). One has to look not only at what a country or firm owes, but also at its assets. This should help answer those financial sector hawks who are raising alarms about government spending. After all, even deficit hawks acknowledge that we should be focusing not on today’s deficit, but on the long-term national debt. Spending, especially on investments in education, technology, and infrastructure, can actually lead to lower long-term deficits. Banks’ short-sightedness helped create the crisis; we cannot let government short-sightedness – prodded by the financial sector – prolong it.

Faster growth and returns on public investment yield higher tax revenues, and a 5 to 6% return is more than enough to offset temporary increases in the national debt. A social cost-benefit analysis (taking into account impacts other than on the budget) makes such expenditures, even when debt-financed, even more attractive.

Finally, most economists agree that, apart from these considerations, the appropriate size of a deficit depends in part on the state of the economy. A weaker economy calls for a larger deficit, and the appropriate size of the deficit in the face of a recession depends on the precise circumstances.

It is here that economists disagree. Forecasting is always difficult, but especially so in troubled times. What has happened is (fortunately) not an everyday occurrence; it would be foolish to look at past recoveries to predict this one.

In America, for instance, bad debt and foreclosures are at levels not seen for three-quarters of a century; the decline in credit in 2009 was the largest since 1942. Comparisons to the Great Depression are also deceptive, because the economy today is so different in so many ways. And nearly all so-called experts have proven highly fallible – witness the United States Federal Reserve’s dismal forecasting record before the crisis.

Yet, even with large deficits, economic growth in the US and Europe is anemic, and forecasts of private-sector growth suggest that in the absence of continued government support, there is risk of continued stagnation – of growth too weak to return unemployment to normal levels anytime soon.

The risks are asymmetric: if these forecasts are wrong, and there is a more robust recovery, then, of course, expenditures can be cut back and/or taxes increased. But if these forecasts are right, then a premature “exit” from deficit spending risks pushing the economy back into recession. This is one of the lessons we should have learned from America’s experience in the Great Depression; it is also one of the lessons to emerge from Japan’s experience in the late 1990’s.

These points are particularly germane for the hardest-hit economies. The United Kingdom, for example, has had a harder time than other countries for an obvious reason: it had a real-estate bubble (though of less consequence than in Spain), and finance, which was at the epicenter of the crisis, played a more important role in its economy than it does in other countries.

The UK’s weaker performance is not the result of worse policies; indeed, compared to the US, its bank bailouts and labor-market policies were, in many ways, far better. It avoided the massive waste of human resources associated with high unemployment in America, where almost one out of five people who would like a full-time job cannot find one.

As the global economy returns to growth, governments should, of course, have plans on the drawing board to raise taxes and cut expenditures. The right balance will inevitably be a subject of dispute. Principles like “it is better to tax bad things than good things” might suggest imposing environmental taxes.

The financial sector has imposed huge externalities on the rest of society. America’s financial industry polluted the world with toxic mortgages, and, in line with the well established “polluter pays” principle, taxes should be imposed on it. Besides, well-designed taxes on the financial sector might help alleviate problems caused by excessive leverage and banks that are too big to fail. Taxes on speculative activity might encourage banks to focus greater attention on performing their key societal role of providing credit.

Over the longer term, most economists agree that governments, especially in advanced industrial countries with aging populations, should be concerned about the sustainability of their policies. But we must be wary of deficit fetishism. Deficits to finance wars or give-aways to the financial sector (as happened on a massive scale in the US) lead to liabilities without corresponding assets, imposing a burden on future generations. But high-return public investments that more than pay for themselves can actually improve the well-being of future generations, and it would be doubly foolish to burden them with debts from unproductive spending and then cut back on productive investments.

These are questions for a later day – at least in many countries, prospects of a robust recovery are, at best, a year or two away. For now, the economics is clear: reducing government spending is a risk not worth taking.

Protests demand more money for education

Yesterday’s Day of Action to protest deep cuts in public education and other vital services was far larger – and occasionally more militant – than many had expected, sending a strong message to Sacramento that it’s time to pursue new revenue options instead of simply cutting the public sector to the bone.

More than 150 people were arrested (including Guardian intern Jobert Poblete, who is still among at least 80 awaiting booking this morning at the overwhelmed Santa Rita Jail in Dublin) for allegedly climbing onto the freeway at Interstate 880 in Oakland and blocking traffic around 5 p.m., the most confrontational event in an otherwise peaceful yet forceful day of protest.

The biggest Bay Area event was outside San Francisco City Hall, were more than a dozen smaller events and marches converged at 5 p.m. Civic Center Plaza was filled with thousands of people of all ages, backgrounds, and ethnicities, from sign-wielding kindergarteners to United Educators of San Francisco President Dennis Kelly, who served as MC of a program that explicitly excluded elected officials.

“We’re here today because never again should any of us feel helpless,” Kelly boomed, declaring, “The budgets of California will not be built on the backs of our future.”

It was indeed an inspiring, passionate presentation to the largest crowd that has filled the plaza since the start of the Iraq War in 2003. Some speakers even drew on that connection in scoffing at statements by elected officials that the budget cuts – which have results in hundreds of teacher layoffs and steep tuition hikes — are unavoidable.

“When the government wants to wage war, the money is there. When the government wants trillions of dollars to bail out the banks, the money is there,” Chabot College teacher Kip Waldo said.

Susan Solomon, a San Francisco kindergarten teacher, said the budget decisions being made today are incredibly myopic and unjust. “We are here today to address a crime, the crime of stealing education from our kids,” she said, going on to attack the belittling mantra that educators need to simply live within the budgets they’re given. “We are sick and tired of doing more with less. Let’s try something new. Let’s try doing more with more.”

Then she spelled out what she – and the majority of people who were out there, people who don’t usually take to the streets in protest – are advocating: “We want progressive taxation. The people and the corporation who have all the money should pay their fair share.”

Whether this nascent movement can help bring that about is yet to be determined, but its leaders sounded confident yesterday. As California Faculty Association President Lil Taiz said, “We have here the seeds of a movement that can lead this state to the kind of future we believe in.”

Tying one on with Dave Attell

Dave Attell had my dream job. In the Comedy Central series, Insomniac, from 2001-2004, Attell took the typical travel show concept and gave it a degenerate edge, showcasing the people and places that come alive in towns across the country after midnight. The show was a smash hit in its own right… but I think he’s tired of talking about it now. So more importantly, he’s a super sharp stand up comedian with a rather dead pan manner and a knack for making hecklers feel like fools. He rocks the USO circuit on the regular, but he’s doing a civilian show on a stage near you shortly (Fri/12 & Sat/13, Cobb’s Comedy Club). He asked me to let y’all know that he’ll be performing new materials- so all the real comedy fans, come out and play.

San Francisco Bay Guardian: So we’re all really stoked you’re coming to San Francisco…

Dave Attell: I love SF. That’s where I started headlining. That’s probably where I’m going to end headlining, too. I have nothing but good thoughts about SF- even though now that it’s all fancy and PC it’s not as fun anymore, everyone knows that.

SFBG: How long have you been doing standup?

DA: Twenty years.

SFBG: Oh yeah, some change has gone down then. The thing I keep reading about you is that you’re a comedian’s comedian. What does that even mean?

DA: It means you can’t act. I can’t. I’m a horrible actor. I like jokes, I like writing jokes. But yeah, I don’t really know what that means. It’s a compliment, I hope.

SFBG: Has your comedy matured/grown over time? New themes?

DA: That’s a great question and the answer is no. Being in your mid forties and still talking about drinking and porn, I’d say the answer is no. I’m a good comic, not a great comic.

SFBG: Who, in your eyes, are?

DA: There are so many great comics. Everyone says Richard Pryor, George Carlin, which is true. The longer I do comedy, I realize it’s hard to always come to the table enthused. Bill Hicks, who was an amazing, important part of SF comedy. He was another guy who was ahead of the curve. But I’m nothing like those guys, I go for dirty humor. I can spread the word about them, though! There’s so many new guys- and I know people don’t like dragging their ass out to a new club, but that’s how it’s supposed to be done, club experiences. Cobb’s is a club where you do that, where you can bring out the new material, it’s great. Every year or so I check in at Cobb’s. 

SFBG: I have to tell you, I have a not so secret dream to be a travel show host. I loved Insomniac, was that a fun project to work on?

DA: Yes. But I’m too old to be a travel show host, I’m a has been. I encourage you to go out and do it, though. We need to see a woman’s perspective. I would go to the Middle East. It’s rough out there, but there’s a few places where you can party. Abu Dhabi and Dubai. It’d be a lot of money, but…

SFBG: Dubai! All I always hear about are those apartment islands they’ve built in the shape of the continents.

DA: Well their economy is in the shitter too, so they’re not building land masses anymore. It’s weird for people who fear God to act like God. Building the earth, isn’t that his job?

SFBG: Were the cities featured ones you were familiar with before the show? How’d you scout the locations and people you talked to?

DA: I mean, it wasn’t magic. It was hit a bar, talk to folks, get a couple shots, roll out. The part no one talks about is the late night jobs. There’s a lot of shows that focus on different jobs now, but I think we were unique on that.

SFBG: Were there any jobs you featured that you could see yourself doing?

DA: Not the coal mine. I hate being trapped. The coal miners have these sleds that go into the mountain, and then after twelve hours they pull them out. I have serious claustrophobia, couldn’t do that. I’m not a big fan of the water either, so not the ocean jobs. Of course, [we did the show] back when there still were jobs.

SFBG: I hear you are a fixture on the USO circuit. What’s that like?

DA: Ah good, a new topic. I’ve done four shows in Iraq, five in Afghanistan. I don’t know if they’re going to want me back, I’m kind of dirty. But really, it’s hard for the troops because it’s really boring, but really, really dangerous. You get a perspective on what these people do and how cool they are. Everybody talks about how “amazing” they are, but they keep it low key, do their jobs, and then come back for more- some of these guys are doing second, third tours of duty. The Olympics, they fill you with pride, but the army… it does, more.

SFBG: Lots of different acts do the USO tour, right? Were you traveling with, like, a bunch of cheerleaders as well?

DA: Being in the USO, you get to see a lot of other acts. The last one I did was with Billy Ray Cyrus. We never would have met otherwise. The thing is there’s USO stuff going on all over the world and the people that do it are really, really cool. The USO has a small budget, its not a government thing, it’s privately funded. I mean, I’m really a nobody in that scene. Robin Williams, Dane Cook, they do it. That’s amazing. The troops, they’re in the dirt, the mud- and all of sudden they look up, and there’s a star.

SFBG: Do you have family that were in the military?

DA: My dad was in the Navy, he told me some great stories. He wasn’t a career man though. Retail was his real calling, him being a Jew.

SFBG: How’d you get into the USO gig?

DA: Why wouldn’t I? I’m too old to fight. I’m lucky to have the opportunity to go over there and do it. These are the times we live in. This is what we do during a war on terror, whether it’s wrong or right. It comes down to; either we have to end the war or I need to get more material.

SFBG: Or we need to get the draft going, new audiences, right?

DA: Right. What we should do, all the people that lose on the Biggest Loser, we should send out there. We should say ‘you can go on this show, but if you lose you have to go to war.’

SFBG: Or how about all the reality shows! There’s your draft.

DA: Right.

Homeowners for Prop. 13 reform

The Chron’s headline says “most want cuts, not taxes, to fix state budget.” The story cites a new Field poll, and the Chron’s not the only paper to spin it that way. The Sacramento Bee also claims that the poll shows widespread support for cuts instead of taxes.


But the folks at Calitics drew a different, more encouraging conclusion:

Mostly cuts: 19%
Equal mix of cuts and taxes: 29%
Mostly taxes: 9%
Taxes only: 4%
No opinion: 8%
So the way this is being reported in the media strikes me as being pretty flawed. The way I read this says 61% of voters want taxes to be some element of the solution to the budget mess, and only 31% want cuts-only.


And as people take to the streets March 4th to protest cuts to education and public services, I think that message will get reinforced. I certainly hope so — and I hope when protesters are interviewed, they don’t make the mistake of saying that “there’s plenty of waste in the budget” or that resources need to be better deployed.


The truth is that we need to raise taxes, particularly on the wealthy, to close this budget gap without destroying the state. I’m a homeowner who wants higher property taxes and better schools; anyone want to join me in Homeowners For Prop. 13 Reform?

MTA board ponders bad options

If Friday’s San Francisco Municipal Transportation Agency decision to cut Muni service by 10 percent was met with a backlash, it didn’t get much better this afternoon as MTA Chief Financial Officer Sonali Bose laid out further options for closing next fiscal year’s $56.4 million projected budget deficit.

One option that was very unpopular but potentially lucrative is the possibility of eliminating transfers. That’s right. Going from the Sunset to North Beach, and need to transfer from the N to the 8X? You’ll be paying twice if the MTA Board of directors goes with this option. It would generate $20.4 million to help close the budget gap.

Other proposed changes included a consolidation of transit stops in the system, charging for metered street parking on Sundays, extending meter hours into the evenings, a reduction in work orders requiring payments to other city departments, window wrapping advertising on MTA buses, and dedicated tax measures that would raise additional funding for Muni.

A further 5 percent service reduction was also not ruled out, though CEO Nathaniel Ford suggested that Bose remove it as part of the list of solutions to the budget crunch. For every 5 percent reduction in service, the MTA saves $7.2 million.

Ford tried to strike a conciliatory tone. “Last Friday was a very difficult day. People were understandably upset,” he said. “We must recognize we can only deliver the services we can afford. Going forward our choices are going to get that much more difficult.”

The criticism of the MTA Board was diverse. Tom Radulovich, Executive Director of Livable City, questioned the future of the board. “I think there’s a very good chance the MTA in it current form won’t see its 11th anniversary because it isn’t doing what voters want it to do.” Radulovich said the MTA had failed to live up to its charter mandate by not seeking new funding for the agency.

Many pro-transit groups argued that the Board should extend meter hours and eliminate free parking on Sunday. They felt the best way to promote public transportation and deal with the budget is to increase costs on drivers in San Francisco.

“There is some easily implementable low hanging fruit,” said Marc Caswell, program manager for the San Francisco Bicycle Coalition. “By increasing parking meters, you will help make transit affordable. You must extend meter hours.” Caswell suggested the board was receiving “political pressure” from the mayor’s office not to extend meter hours or eliminate free Sunday parking.

Two issues from Friday’s meeting were continued this afternoon. One was the proposal to exclude the 8X bus lines from the premium pass. Eric Williams from Transport Workers Union Local 250-A was vocal. “You’re putting these raises on the less fortunate. The 8X are coming from the Sunnydale neighborhood. They’re going to get on the local 9 and pack buses. These people are coming off housing projects to get to work.”

The second continued item surrounded the proposed elimination of free parking for employees who work at city garages, effectively charging them to park in the garage where they work. The irony of the proposal was not lost on Mission and Fifth Garage Supervisor Jorge Carrillo who showed up at the hearing to explain to the MTA board that one of his security guards will have to work 30 hours just to pay the monthly 300 dollar parking fee. “It’s outrageous. I live 50 miles away from the garage. That’s two to three hours to get home on public transportation.”

In line with projected budge deficits was a request to extend the current state of fiscal emergency through 2012. Declaring a fiscal emergency allows the MTA to avoid the California Environment Quality Act (CEQA) requirements should it decide to cut service or increase fares over the next two years.

Bose concluded her presentation with a reminder that there will be a town hall meeting on the proposals next Wednesday, March 10th at 6:00pm at 1 South Van Ness on the second floor. The SFMTA Board meets again March 30th.

Taxi turbulence

It’s 10:20 p.m. on a recent Saturday night. Cab driver Dorian Lavender picks up a middle-aged couple outside the Gold Club, a strip joint in SoMa.

The couple is sharply dressed for a night out. After requesting the Mitchell Brothers’ O’Farrell Theatre as their destination, the man brags to Lavender about having had sex with a stripper in one of the club’s private rooms. His female companion smiles and says nothing.

“This is before I met her,” the man explains. “We’re swingers.”

Minutes later, beneath the theater’s flashing marquee, the man hands the driver a $20 bill for the $10 fare. “Keep the change,” he says.

A few blocks away, a young couple flags the cab from the corner of Bush and Polk streets. They are talkative and entertained as Lavender tells them about the swingers. Ten minutes later, the meter reads $9.86. Apologizing, the young man hands him $11.

Lavender folds the bills into the cash-wad kept in his pocket.

“That’s how it goes with cab driving,” he says. “The nice couple tips 10 percent, the weird swingers tip 100 percent — and they were more interesting to talk to.”

At 25, Lavender considers cab driving a great gig and survives working only three shifts a week. He enjoys the cash, freedom, and unpredictable encounters. He’s even landed a few dates. A lot of career cabbies start driving for the same reasons. But after the excitement wears off, it turns out to be a tough job.

A typical cab driver in San Francisco makes less than $30,000 a year. Before drivers even start a shift, gate fees (covering the rental on the cab and the use of its permit, known here as a medallion), gas, and graft have already set them back close to $100. Bribes are commonplace in the industry, used to ensure weekend shifts, airport fares, and newer cars.

The industry offers no retirement plan or health coverage. In fact, the primary reason some people stay behind the wheel long after the thrill is gone is the promise that at some point, after maybe 15 years, an active driver becomes eligible for his or her own medallion. It costs almost nothing, and offers a tremendous benefit: drivers with medallions no longer pay high gate fees, get better shifts — and can lease out the permit when they’re not working. The lease revenue alone can nearly double a driver’s income.

Since 1978, medallions have been issued only to working drivers, and entirely on the basis of a waiting list that now numbers 3,200 names. New medallions become available when permit-holders retire, die, or are forced by disability to stop driving.

That system — and the entire cab industry — is about to change, profoundly. On Feb. 26, the San Francisco Municipal Transportation Agency agreed to allow some permits to be sold on the open market to help close its huge budget deficit. When the dust settles and the implications of that decision become clear, life for cab drivers and passengers will be very different.

Some say the industry will be better; some say it will be much worse — but the truth is, nobody really knows.

 

PRIVATIZING PERMITS

Mayor Gavin Newsom’s adminstration has talked about allowing the sale of permits for several years, but only in the past few months has Christine Hayashi, SFMTA’s deputy director of taxi services, come up with a detailed plan.

It’s aimed at addressing what some drivers call an unfair and flawed system. Permit-holders by law must drive a minimum number of shifts, and it they get hurt or just get too old to drive, they have to surrender their medallions, leaving them with no source of income.

It will also help SFMTA’s budget — the city could sell unclaimed permits for big money and would get a cut of every other sale.

But critics, including Judge Quentin Kopp, the former San Francisco supervisor who wrote the 1978 law that created the old system, say the medallion holders just want to cash in on something that has always been city property.

The pilot project approved by the SFMTA board allows the city to sell up to 60 medallions directly to drivers and allow about 300 drivers over the age of 70 to sell their medallions to any qualified driver who can come up with the cash. The program aims to set a fixed selling price, but has yet to do so, instead setting a $400,000 limit. It is estimated that medallions will sell for no less than $200,000.

That, of course, will be a huge windfall to the sellers, who paid nothing for their permits.

The pilot program was essentially a done deal even before the Feb. 26 vote. In an e-mail to the Guardian, agency spokesperson Judson True confirmed that $11 million in taxi revenue had been added into the MTA budget before the vote took place.

 

THE GREED FACTOR

Kopp sat behind the desk in his West Portal neighborhood office a week before the MTA vote, bitterly condemning the medallion sales program. “It’s based on greed. It’s based on City Hall greed,” he said. The stentorian 82-year-old occasionally thumped the desk with his fist for emphasis as he launched into the history of Proposition K. Then-Sup. Kopp authored that landmark legislation prohibiting private companies from owning driving permits, instead granting control to drivers.

“This will reverse a system that gave a genuine cab driver the opportunity to obtain a permit and replace it with a system that restores the ability of people with lots of money to buy a permit,” he said.

But Kopp’s bill had some unforeseen consequences. The list has become so long that medallions are being issued to people in their 60s and 70s — and some of those people are driving passengers around town despite failing reflexes, eyesight, and motor skills.

Carl Macmurdo, president of the Medallion Holders Association (MHA), believes that selling medallions will provide an exit plan for geriatric drivers while giving younger cabbies an entry opportunity. At 59, Macmurdo is still a full-time driver and has been in the industry 27 years.

It makes sense that MHA members are generally in favor of the pilot program — they could potentially make a mountain of money. Although only those over the age of 70 are now eligible to sell them, the age limit could be lowered in the future.

 

INDENTURED SERVANTS

The United Taxi Workers (UTW) headquarters consists of a few cramped offices on the fourth floor of an old office building in the Mission District. All the interior trim is painted taxi-yellow. In late January, UTW spokespersons Mark Gruberg and Rua Graffis sat at a large table, fearing the worst.

They predict the sale of medallions will provide large cab companies with the equivalent of indentured servants. They say drivers will need upwards of a $200,000 loan to purchase a medallion, requiring a hefty downpayment.

Few drivers will be able to pay for a permit with savings, so the system will only work if someone is willing to finance those purchases. And drivers who are recent immigrants or have bad credit may not be able to get traditional loans. So they could wind up borrowing from their employers, the cab companies, UTW activists say — and by owning the debt the companies will essentially own the medallion.

“Supposedly there’s going to be a provision that says a cab company can’t lend money to a driver toward purchasing a medallion. But it would be so easy to get around that by hooking up with an outside lender,” Gruberg said.

Another fear is that the pilot program will favor young drivers and punish veterans. “Suppose a 27 year-old is on the list and I’m 63. Which one of us is the bank more likely to lend money to?” Graffis asked.

Under the pilot program, drivers will have the option to purchase according to seniority on the list. But without a lender, that’s little help.

 

WHO’S GETTING SCREWED

At 1 p.m. the day of the SFMTA vote, Bill Mounsey and David Barlow were sitting on a bench outside the hearing room. Both are members of UTW and planned to speak in protest of the pilot program.

Mounsey is 63. He’s been on the list for 13 years and is No. 200. He is part of the group most vulnerable in the medallion reform process — drivers who have already waited more than a decade but still have years to go.

If at any point the board decides to eradicate the list before he receives a medallion, Mounsey’s years of waiting will be wasted. “I would never buy one. I’m 63 years-old, no one would ever give me a loan,” he said.

For now, the wait list survives. Under the pilot program, one medallion will be given away for every one sold until the list is exhausted. However, with only half as many medallions being given out, Mounsey fears the list will move half as fast.

Around 50 people attended the meeting, a small fraction of the city’s cab drivers. At 3:56 p.m. the board passed the pilot program and Prop. K moved a little closer toward death.

Hayashi spent more than 175 hours trying to create a pilot program that provides the city with revenue and benefits the taxi drivers. She has made an effort to engage the taxi community and worked with a group of drivers to draft the proposal. She even plans on getting a taxi license.

After the City Hall meeting, Hayashi explained the challenges facing the pilot program over coffee in a downtown cafe. Before March 30, when the proposal is set for a final SFMTA vote, Hayashi must lock down lenders, create lending programs feasible for drivers, and set a fixed selling price for the medallions.

The blaring problem with the pilot program is a lack of committed lenders ready to finance cab drivers’ loans. Bank of the West has expressed interest, as well as two New York credit unions experienced in medallion loans and two San Francisco credit unions.

But how will those loans be structured? Who will qualify? How much of a downpayment will drivers need? And how, in the end, will this change the experience and qualifications of the drivers — and the quality of cab service in the city?

Hayashi sounds confident. “Good service depends on happy drivers. Our goal is to restore professional pride for the drivers, allow them to feel that taxi driving is a career and a respected profession,” she said.

But a lot — a whole lot — can go wrong with this major change in a complex industry that provides essential service to residents and tourists alike. And once the city moves down the path to private medallions, it’s going to be hard to go back.

Expanding movement

When University of California Berkeley students staged building occupations last fall, their furious, brazen response to startling tuition hikes and staff cutbacks captured the attention of the world, recalling the radical actions of earlier generations.

Yet the thrust behind the March 4 Strike and Day of Action, a mass mobilization for public education and services that is reaching into all corners of the state and spreading nationwide, appears to stem from widespread agitation that extends well beyond the flare-ups on college campuses.

"What’s historic about this is that pre-K through PhD has never walked together," said Lillian Taiz, president of the California Faculty Association, which represents faculty in the California State University system. "We have often been pitted against one another, and I think everyone feels finally, in the end, there is no difference in importance between pre-K and PhD. We need it all."

The historic new alliance faces an uphill climb in an environment characterized by a devastating budget crisis at the state level. California — the world’s eighth-largest economy — hovers around 47th in the nation in terms of per-pupil spending, and the most recent wave of budget rollbacks has cut to the bone.

Students and teachers across the Bay Area argue that with dramatic slashes in funding, the educational system is failing youth. Class sizes are ballooning to claustrophobic levels, students are unable to take their desired courses, fees are going up, bathrooms are getting cleaned less frequently, and staffers are getting stressed by overwhelming workloads. "Classes are jam-packed," Taiz says. "You have kids sitting on the floor. You have students just begging to be allowed in a class."

As University of California students decry a 32 percent hike in fees, the California State University system is suffering from damage inflicted by 2,000 faculty layoffs over the past year. The San Francisco Unified School District, meanwhile, is staring down an estimated $113 million budget deficit over the next two years, and 900 layoff notices recently were issued to teachers, librarians, secretaries, and other school employees to warn them that their jobs could be slashed by the end of the school year.

When San Francisco’s school district faced a gaping budget shortfall during the last budget cycle, it was propped up by a combination of Rainy Day Fund reserve dollars and stimulus funding from the American Recovery and Reinvestment Act. With no such safety nets in place this time around, anxiety levels are higher and the outlook is uncertain.

March 4 is shaping up to be more than an opportunity to vent frustrations to elected leaders. Instead, organizers describe it as a rallying point for a movement to defend public education that has caught on like wildfire, uniting people from different worlds. Pickets and rallies will be staged throughout the region. Thousands are expected to swarm Civic Center Plaza in San Francisco. Students from a handful of East Bay campuses are organizing marches to Frank Ogawa Plaza in downtown Oakland. Students and faculty from Berkeley will be boarding buses to take the message to Sacramento. The Oakland Unified School district will host a districtwide mock "disaster drill" to call attention to the disastrous budget. Even public transit activists opposed to the latest round of Muni service cuts and fare hikes are joining the protests, hoping to expand the discussion to support vital public services (for details on these and other events, see "Alerts" opposite this page).

"We’ve never gotten this level of activism over anything in SF since I’ve been here," says Matthew Hardy, communications director for United Educators of San Francisco. "There’s a growing movement for progressive taxation and budget reform instead of draconian cuts."

Taiz, who teaches history at Cal State Los Angeles, described March 4 as an opportunity to fill a void in leadership. "Historically, in these moments where ordinary people step up to the plate, you end up leading the leaders," she said. "We are kind of shocked, but in truth, we do know what has to be done." Quality education isn’t just important for young people, but for society as a whole, she argued. "I am a baby boomer, and if the folks coming up behind me don’t have really, really good jobs, I’m going to be eating dog food. Because those are the people who pay Social Security and pay the taxes."

In the week preceding March 4, teachers and students throughout the Bay Area were in a frenzy of preparation.

Carlos Baron, a theater professor at SF State, was wondering whether the grand procession of papier-mâché puppets his theater students will unveil on the March 4 Day of Action should take a V-shape or some other form. "The main puppet is the Draculator," explained Baron, a Chilean who directed plays in the Salvador Allende era before he began teaching at SF State in 1978. "It’s a cross between the Terminator-Governor and Dracula. But also it doubles as a banker and a general."

When asked how funding cutbacks affect students, Baron didn’t hesitate. "It impedes the creation of a positive vision for themselves and this society," he said. It stunts "the development of the imagination," he added. "We are trained as individuals to accept our failure and our smallness because we’re familiar with it. They don’t want an educated population, a sensitive population, a dreaming population. Would we select Schwarzenegger?"

Nicole Abreu Shepard, a first-grade teacher at Buena Vista Elementary in San Francisco’s Mission District, was collecting permission slips from parents to take her students to a rally and march down 24th Street. "The entire school is walking out," Abreu Shepherd said. Buena Vista’s art program exists solely because parents volunteer their time, she explained. More than half the students qualify for free or reduced lunch, and many incoming kindergarteners or preschoolers are new to the English language. Now there are proposals on the table to increase kindergarten class sizes to 25 or possibly even 30 students. "It’s sort of tying their hands behind their back and asking them to teach on one foot," she noted, and worried about the eventual result. "It’s going to be harder and harder to keep parents who could afford private school in a public school system."

Meanwhile, at the UC Berkeley campus, Krystof Cantor was sitting behind a table heaped with piles of radical literature bearing titles such as "After the Fall: Communiques from an Occupied California." Cantor, who earned his PhD in vision science in 2005, was joining student organizers in making one last push to drum up student interest in March 4 events at a multi-faceted event called "Rolling University." Late on the evening of Feb. 26, a dance party on the Berkeley campus morphed into a street riot — replete with ignited Dumpsters — in downtown Berkeley. The incident attracted media attention and drew public criticism from administrative officials.

The radicalized student movement that has erupted on the UC Berkeley campus is "very much about seizing power," Cantor told the Guardian several days before. "It’s been disruptive, it’s been militant, and it’s been creative. That’s very scary," to the administrators the movement is targeting, he added.

That focused pressure on UC administrators sets these students apart from the coalition of UC Berkeley faculty members and student government members and allies who are coordinating bus trips to protest in Sacramento March 4, he explained. "Sacramento’s not innocent, but it’s not like the administrators are just doing what they have to do," he charged, pointing to new construction projects on campus even as workers are hit with layoffs and furloughs, plus an increasing trend of privatizing on-campus jobs and services. "You can save the public sector by pouring money into it. But it won’t work if the people in charge … want to privatize everything."

Jasper Bernes, a graduate student in English who was seated next to Cantor, noted that the occupation tactic is catching on at other campuses. "I have no doubt that March 4 will greet us with news of many occupations," he said.

Baron, the Chilean theater professor, noted that some SF State students had occupied a business school building in protest of budget cuts. "They were pissed," he said. "They wanted to do something radical. They really inconvenienced a lot of people — but they took chances nonetheless. I went there, and I locked arms with them for awhile." At the same time, he wondered about how effective it was, he said.

And for all the months of preparation and visioning, Baron said he also wonders what will ultimately be borne out of the marches, rallies, pickets, and procession of lovingly crafted street puppets he helped breathe life into. For all the hard work and planning, he says, "My problem is not so much March 4. It’s March 5."
