Lessons from New London debacle

New London, Connecticut, became famous a few years back for seizing the homes of dozens of families to make way for a commercial development by the pharma giant Pfizer. Now, a major Supreme Court case later, the project has gone forward, the houses have been demolished — and now Pfizer, after years of tax breaks and tens of millions of dollars in public subsidies, is bailing on the whole thing.

It was on odd Supreme Court case, with Justice Clarence Thomas, of all people, making the case against a private company getting tax benefits. But it’s hard to argue with the results — this was a major disaster. And there’s a lesson here: If governments put too much faith and hope in the promises of big business to save their economies, they’re going to be badly disappointed.

Lennar Corp. isn’t demolishing any houses in Bayview/Hunters Point, but the construction giant will completely transform that area — and then what? Suppose Lennar goes broke halfway through? It all started with Stella.

I’d made my weekly (OK, sometimes twice or thrice-weekly) stop at Amnesia and ordered a pint of the Belgian lager not-so-affectionately known among beer snobs as "British Budweiser." Why Stella? It’s light, easy to drink a lot of, and feels classier than PBR. So when I’m not on a $2-a-beer budget, Stella Artois is often what I order.

This time, however, the mustachioed bartender Matthew Harman didn’t simply poor me a glass. It was earlier than usual. He had some time. And he knew me well enough to guess I might be open to the speech he was about to give.

"Do you really want a Stella?" he asked. "Because there are better beers that aren’t shipped halfway across the world and owned by InBev." I consented to let him give me tastes of alternatives and eventually settled on a slightly more hoppy but equally drinkable lager from Sudwerk brewery in Davis.

I enjoyed the beer. But better yet, I enjoyed the wake-up call. Though I’ve become accustomed to buying groceries, clothing, gifts, coffee, and even liquor from local, independent manufacturers and retailers, when it comes to beer, I’ve been lazy. I don’t think before I drink.

What’s worse? I live in the land of craft brews. Though there are now 1,500 craft breweries nationwide, the movement started in Northern California, Oregon, and Washington — with flagship brands like Anchor, Pyramid, and Anderson Valley within driving distance (or, in the case of Anchor, a stone’s throw) from my office. And as the industry has grown and changed, there are ever more options for a range of palates — and purses. In short: there’s little excuse for thoughtless imbibing.

So why drink local? First, there’s the environmental reason: it requires a lot of energy to ship all those heavy bottles and kegs full of liquid across the country and around the world. Then there’s wanting to support the local economy: money spent on Bay Area businesses stays in the Bay Area. There’s the more intangible concept of local pride. "We support our lousy local sports teams," says Lars Larson, master brewer at Berkeley’s Trumer Brauerei. "Why not support our local brewing excellence?" And perhaps most important is taste: beer, like produce and dairy products, is best when fresh.

But the world of beer-making is complex. When it comes to assessing a brewery’s greenness, for example, the question often becomes: how green? If you grow your own hops but send them to Wisconsin for brewing, is that still environmentally sound? Or if a brewery is based in Seattle but makes beer in Berkeley, does it still support the local economy? The answers vary and can be subjective. But the good news is that whatever the reason for wanting to choose brews more thoughtfully, there’s a nearby option — or 12 — to satisfy it.

If you still just love the taste of Stella, or want an import that has no local substitute (like Guinness), or appreciate that the Budweiser you’re sipping was probably made in a brewery 60 miles away, well, more power to you. Even Harman won’t argue (though he’ll happily give tastings of alternatives to anyone who stops by the Valencia Street bar Sundays at 6 p.m.). The real point is to use the same criteria for choosing beer — values, politics, and palate — you do for food and wine. Here’s hoping our guide to some of the Bay Area’s famed and favorite breweries will help you make that decision.

ANCHOR BREWING COMPANY


This landmark brewery has existed in one form or another since 1896, making it the granddaddy of Bay Area brewing. Its current identity comes to us with thanks to Fritz Maytag, who bought 51 percent of the operation in 1965 and is still the driving force behind the company best known for its unique Anchor Steam beer. We love Anchor’s handcrafted brews, commitment to the community, and willingness to experiment with new ideas, including distilling gin and whiskey.

ANDERSON VALLEY BREWING COMPANY


This pillar of the Bay Area craft brew scene has been building its reputation on balanced, drinkable options like Boont Amber since 1987. Other favorites include the nearly hopless Summer Solstice, the oh-so-hoppy Hop Ottin’ IPA, and the Brother David line of abbey-style ales (named for Toronado owner David Keene). But we’re particularly excited about the 2009 Estate Fresh Hop beer, produced with hops grown on brewery grounds (where, by the way, all water is taken from wells on the property and all beer is made in a facility that’s 40 percent solar-powered).

MOONLIGHT BREWING


Beer drinkers looking for a truly local, truly independent brewery need look no further than this Sonoma County one-man operation. Well-respected brewer Brian Hunt established the tiny business in 1992 and still delivers his keg-only offerings like Death and Taxes black beer, Reality Czeck pils, and Homegrown Fresh Hop Ale himself. Hunt also has been growing a share of his hops onsite since 2003.

PYRAMID BREWING COMPANY


One of the first craft breweries to appear on the public’s radar, this Seattle-based company also has been operating out of its Berkeley brewery and alehouse since 1997. Until recently, Pyramid operated as a publicly-owned company; now it is part of the Independent Brewers Union. Under this arrangement, the brewery is owned by East Coast brewers Mad Hat but conducts its business as an autonomous unit. The company also has revamped its image, renaming classics like Pyramid Hefeweizen (now Haywire Hefeweizen) and Pyramid Apricot Ale (now Audacious Apricot Ale) and introducing a host of new offerings — some only available at Pyramid brewpubs. But with locations in Sacramento, Walnut Creek, and Berkeley, that means plenty of access to exclusives like the nitrogenated Draught Pale Ale or the session beer Crystal Wheat Ale.

RUSSIAN RIVER


Now based in Santa Rosa, the brewery most famous for its Pliny the Elder Double IPA used to be owned by Korbel Champagne Cellars. Vinnie Cilurzo and his partner bought the business in 2003, but have continued to combine aspects of both industries, including a line of beers that are aged in used wine barrels from local wineries. Look for tasting nights of this special line, nicknamed the "’Tion" beers, at pubs like Toronado.

The big news surrounding the Chico-based brewery that introduced much of America to Pale Ale is its upcoming Estate Harvest Ale, inspired by the winemaking of its Napa and Sonoma neighbors and made with hops and barley grown onsite. Also exciting? Two collaborations with Maryland-based brewery Dogfish Head — Limb and Life, released on draft this month, and Life and Limb, due out in 24-oz bottles and limited draft in November.

TRUMER BRAUEREI


This Berkeley brewery encompasses what’s advantageous about imported and local beers. The only non-Austrian outlet for this 400-year-old recipe gets many of its ingredients from its sister company in Salzburg. But bottles, packaging, and, of course, the beer, all are made in the East Bay. What makes Trumer special is a process called "endosperm mashing," which means brewers separate the barley husks from the starchy endosperm during milling, then reintroduce them at the end of the process to highlight the warm, toasty flavor of the malt. Trumer also uses a process called krausening, a slow, secondary fermentation that helps build natural carbonation. (One reason for its signature glassware is to show off the tiny Champagne-like bubbles.)

21ST AMENDMENT


This Prohibition-themed South Park brewery has been getting lots of attention lately for its canned craft beers — Hell or High Watermelon Wheat Beer and Brew Free! Or Die IPA — and for good reason. Though cans are the best way to keep beer fresh (since sunlight can’t penetrate metal), convenient for carrying, allowed at locales where glass isn’t, and (let’s face it) good for shotgunning, the delivery method has long been associated with cheap, watery beer. But this stigma seems to be slowly eroding, thanks in no small part to forward-thinking breweries like 21st Amendment.

Light beer’s plight

I like to drink beers. Plural. I’m the guy the ad men were thinking of in that classic jingle, the one that goes "Shaefer is the one beer to have when you’re having more than one." One summer a few years back, my friends and I polished off 1,000 cans of beer over a four-day weekend on Lake Shasta; there were only about 10 of us drinking. Do the math on that one, and you get a sense of my taste for the blessed amber fluid.

But that was then, and this is now. And today I have two kids who wake up at 6 a.m. and keep me on the go day and night; I’m not as young as I used to be; and I can’t handle the intoxication the way I once did.

But I still drink beers, plural, every day, and I’m not about to give it up. What I’ve done is switched to light beer. Correction: "Light" is a bad word. Among serious drinkers, it’s called "session beer."

It’s a choice more and more people are making in this country — beer with lower alcohol content is one of the fastest growing parts of the industry. But it presents a problem: how do you drink local (and high quality beer) when most of the craft breweries and brewpubs focus almost entirely on the heavy and the strong?

Quick definition here: light beer is generally promoted and advertised as having fewer calories than regular brew. But I could care less about beer making me fat (I can always give up food). What I’m talking about is what’s known in the business as ABV; that’s alcohol by volume. Typical American beer — say, Budweiser — runs about 5 percent. Typical craft brew — say, Anchor Liberty Ale — is about 6 percent. The more serious stuff is even stronger — Lagunitas Maximum India Pale Ale, for example, clocks in at 7 percent.

Typical light beer — say, Bud Light, at 4.2 percent ABV — has almost 20 percent less alcohol than Bud, 30 percent less than Liberty Ale, and only about half as much as some of the more extreme brews.

And for those of us who would rather have four light beers than two Imperial Red Ales (and really — in America, is that even a choice?), the craft brew pickings are fairly slim. Especially in Northern California.

"You are living in the land of the IPA," Bill Manley, communications coordinator for Sierra Nevada brewery, which makes no lighter beers, told me.

It’s not as if we’re without choices. Anchor makes a Small Beer (with the leftovers from it’s brutally strong Barleywine Ale) that comes in at about 3.5 percent ABV, but you almost never see it in stores. The 21st Amendment brewpub makes an excellent Great American Bitter that meets the session-beer standard of less than 4.5 percent. Magnolia makes an English Mild, and there’s Stone Levitation Ale (4.4 percent). But again: check out most liquor stores and none of those are on the shelf.

Across the country, that’s starting to change. Lew Bryson, a beer writer and blogger in Pennsylvania, has started the Session Beer Project (sessionbeerproject.blogspot.com) to share information about full-flavored, high-quality brews that don’t knock you silly after a bottle or two. "There are more people like us than most craft brewers would credit," Bryson told me.

The term "session beer" comes from England. By some accounts, it dates back to World War II when pubs were only open for short "sessions" so the workers could get back to the munitions plants in a relatively functional state. By Bryson’s definition, a session beer has an ABV below 4.5 percent and doesn’t overwhelm the party.

There are distinct advantages to lower-alcohol beers. "I was at a session brew festival two years ago and went through six pints in about two hours," he said. "I keep a Breathalyzer in my car, and when it was time to go home, I blew .02" — well within the legal limit in every state in America.

A brewpub near Bryson’s house on the outskirts of Philly sells a Belgian ale called Mirage with an ABV of just 2.9 percent. "I can have a couple of pints with lunch and it doesn’t blow my entire afternoon," he said.

Yet the reluctance remains. "A lot of brewers, they hear low-alcohol and they think light beer — and that’s the enemy," Bryson said.

Mike Riley, marketing director at Anderson Valley Brewing that makes no beer with less than 5 percent ABV, added: "It’s one of those stigmas that’s gone on for a long time."

In fact, I could only find one craft brewer in the country that actually makes a "light" beer: Minhas Brewery in Monroe, Wis., which makes Huber Light and Minhas Light. "People were asking for it," Gary Olsen, the brewery manager told me. "Our first reaction was, why make something that doesn’t taste like anything? But we found out you can make a very good lighter beer."

Yes, indeed. And when Anchor starts making (and marketing) Liberty Ale Light, I promise — I’ll give up Bud Light forever. (Tim Redmond)

The new police chief, who started out with a lot of promise, has been sending some very bad signals the past week.

Chief George Gascón told us earlier this month that he was sympathetic to the efforts of Sup. David Campos to protect immigrant kids from deportation. He also said he agreed that the cops and probation officers shouldn’t be deciding when to call in the federal immigration authorities. Yet now that the mayor said he will defy the Campos legislation (see page 11), Gascón told the San Francisco Chronicle he’s siding with Newsom. That’s a pretty cosmic wimp-out — and it only took a few days.

Then there’s the shake-up of top staff — which looks to me like a total cave-in to the Police Officers Association. The POA types (who have been associated with a lot of bad stuff over the years) got tough-guy cop Greg Corrales assigned back as captain of Mission Station (where he got in trouble during the Fajitagate scandal, but ultimately faced no discipline. They got Greg Suhr, who had been demoted on a pretty bogus technicality, a new career shot as captain of the Bayview station.

Paul Chignell, one of the rare almost-liberals in the department who was doing a good job at Taraval Station, has been exiled to the night shift. Al Casciato, who supported community policing, has been bounced out as captain of Northern Station in the Western Addition. "This completely belies Gascón’s promises about community policing," Sup. Ross Mirkarimi told me. "These unannounced and unplanned rotations (of district captains) undermine the whole community-policing idea."

And perhaps most alarming, the chief wants to bring back the old SFPD intelligence unit — once again turning local cops into spies.

The intelligence squad was a nightmare. Back in the early 1990s, an intel cop was spying on Arab American and Palestinian groups and passing along the data to the private Anti-Defamation League of B’nai B’rith. Cops were spying on peace activists and protesters. They even had a file on me. When all that started to come out, the city properly shut the spy shop down.

Now Gascón wants to bring it back, citing fears about terrorism. As if there aren’t enough government agencies spying on people already. And SFPD has enough trouble solving murders and keeping its own house in order — opening a spy agency is a really, really bad idea.

Gascón is also refusing to tell Mirkarimi and the other supervisors how much taxpayer money gets spent sending officers around with the mayor as he campaigns up and down the state. I could argue that the Newsom for Governor campaign ought to reimburse the city for those expenses — but Gascón won’t even produce a gross figure. His claim: Telling the taxpayers how much the mayor’s security detail costs threaten Newsom’s security.

I don’t buy it. We’re not asking for protection plans, schedules, deployments, or anything else — just a bottom-line cash number. SFPD doesn’t need spies or a black budget. If Gascón thinks that style is going to work here, he’s going to run into trouble, quick.

Will Arnie’s ‘park closure solution’ save Candlestick Point?

Does San Francisco really need to sell Candlestick Point park for Lennar condos?

Governor Arnold Schwarzenegger has unveiled a plan to allow for all state parks to remain open without increasing Parks and Recreation budget appropriation. Does this mean the Bayview’s only major park can be saved? Developers are arguing that if the state sells a chunk of the waterfront property for $50 million, the rest of the park can be saved. But environmentalists disagree, noting that Lennar simply wants the land for luxury condos.

“Working closely with my Departments of Finance and Parks and Recreation, we have successfully found a way to avoid closing parks this year,” Schwarzenegger said in a press release today. “This is fantastic news for all Californians.”

But does this mean that Sen. Mark Leno’s SB 792 is no longer necessary?

Leno’s bill would allow the state to sell a chunk of Candlestick Point State Recreation Area for $50 million, so that developer Lennar, which has entered into a nebulous public-private partnership with the city of San Francisco, can build luxury condos on this waterfront parkland.

Leno’s bill, which the Assembly and the Senate have approved, is sitting on Arnie’s desk awaiting the governor’s signature. But it has faced stiff opposition from environmental groups in recent months.

And their neutrality was only recently secured, based on the spurious argument that, without the bill’s approval, Candlestick Point SRA would have to closed in its entirerity.

But now the Governor is proposing to reduce ongoing maintenance for the remainder of 2009-10, eliminate all major equipment purchases, and reduce hours and/or days of operation at most State Park units, expenditures on seasonal staff, and staffing and operations at State Parks headquarters.

According to Arnie’s proposal, some facilities could close weekdays and be open on weekends and holidays, or portions of a unit could be closed, such as the back loop of a campground. For a park with multiple campgrounds, one whole campground or day use facility could be closed while the rest of the park remains open, while parks that already close due to seasonal conditions could see longer closures.

“Service reductions will be planned to minimize disruptions to visitors, achieve cost savings and maintain park fee revenues,” the memo says.

Hmm. Seems like Arnie’s memo just gave Candlestick Point park supporters more ammo in their ongoing quest to challenge Lennar’s plan to take 23 acres of Candlestick Point SRA.

Lennar never spelled out this plan to take a chunk of the Bayview’s only major park, when they asked voters to approve Prop. G in 2008.

Instead, Prop. G was billed as a way to clean-up the abandoned Hunters Point shipyard and “create” hundreds of new acres of parkland.

It wasn’t until after Prop. G passed, that Lennar began publicly arguing that they would need 42 acres of the existing parkland, if the rest of their plan, which involves building 10,500 housing units on 770 acres of former industrial/ military land, is to pencil out. As for the new acres of parkland, that turned out to be acres of polluted shipyard that Lennar was proposing to cap with a cement cover and convert into a park.

Understandably angered, park advocates beat Lennar down to 23 acres, this fall, during the most recent round of the “parks for condos” battle.

Now, in light of Arnie’s plan and the soon-to-be released environmental impact report for Lennar’s massive redevelopment plan, those battlelines are perhaps, once again about to be redrawn. Only this time in favor of the park.

The proposal by city officials and Lennar Corp. to build more than 10,000 new housing units at Hunters Point Shipyard/Candlestick Point is entering a critical phase, particularly for Bayview-Hunters Point residents who want greater oversight and scrutiny of the project.

Candidates are lining up to replace termed-out District 10 Sup. Sophie Maxwell next year; the project’s draft environmental impact report will be released, considered for approval and potentially challenged; and Lennar officials will seek to get the final development agreement with the city signed before Mayor Gavin Newsom leaves office in 2011, or earlier.

The 770-acre redevelopment plan, which the Mayor’s Office is touting as a shining example of a public-private partnership, has come under repeated attack from community advocates after Lennar’s failures to monitor and control toxic asbestos dust at the shipyard. The crash of the housing market and plunge in the company’s stock price also triggered concerns about the project.

And in light of the U.S. Navy’s recent decision to dissolve the Hunters Point Shipyard Restoration Advisory Board (RAB), the community is concerned that decisions about radiologically-affected dumps and the shipyard’s early transfer from the Navy to the city could occur without important public oversight.

Another aspect of the project — a proposal to build condos on 42 acres of Candlestick Point State Recreation Area — was criticized by the Sierra Club, Arc Ecology, and Friends of Candlestick Park. Lennar argued it was necessary for the project to pencil out and this sale of state land was to be authorized by Senate Bill 792, sponsored by Sen. Mark Leno.

In August, Leno secured the neutrality of the environmental groups and the support of the California Assembly (but not Assembly Member Tom Ammiano, the lone dissenting vote) for an amended version of his bill, arguing that selling 23 acres for $50 million would spare the rest of Candlestick Point SRA from being closed by budget cuts. The legislation now awaits Gov. Arnold Schwarzenegger’s signature.

Now, with the project’s EIR due to be released Sept. 28, people have the chance to register concerns about plans for such a massive development project, which includes condos on the Bayview’s only major park and a controversial bridge over Yosemite Slough.

On Sept. 15, community members packed the Board of Supervisors’ meeting to demand an investigation into their concerns, which also include the apparent inability of Newsom’s African American Out Migration task force to issue its overdue final report about the ongoing exodus of the city’s black population, which this project could exacerbate.

Sup. John Avalos told us he is now gathering information on the issue and hopes to schedule Land Use Committee hearings on the shipyard cleanup and Lennar’s economic health. "The documentation gives real strength and power to the community’s contentions," Avalos said.

He also noted that Maxwell is scheduling a hearing into the dissolution of the RAB, while Sup. Ross Mirkarimi is resurrecting legislation that seeks to put the San Francisco Redevelopment Authority under the control of the Board of Supervisors.

Arc Ecology director Saul Bloom said his group will study the project’s EIR to see if it accurately assesses the effects of Lennar’s development.

"We are concerned about the impact of truck traffic, the bridge over Yosemite Slough, and whether the transportation plan is going to effectively put the Bayview between three freeways," Bloom said. "But we’re going to be even-handed. If the EIR does a good job, we plan to say so."

Jaron Browne of the Bayview advocacy group POWER (People Organized to Win Employment Rights) told the Guardian that her group wants the shipyard cleaned up and the community respected.

"This is not just a Bayview issue," Browne said. "The whole city will be affected by the decisions that take place in terms of the future of affordable housing and environmental protection."

Assembly supports sale of Candlestick Point Park

On Wednesday night, as folks were getting ready to watch President Barack Obama’s speech about health care, the State Assembly voted 69-1 in support of an amended version of Sen. Mark Leno’s SB 792.

Leno’s bill, which is now back in the Senate, gives the State the authority to sell 23 acres of Candlestick Point State Recreation Area for $50 million.

Assemblymember Tom Ammiano was the lone dissenter on Leno’s bill with seven others abstaining or not voting.

Those voting “aye” included Assemblymembers Fiona Ma and Nancy Skinner. Florida-based developer Lennar, which has entered into a public-private partnership with the City of San Francisco to redevelop 770-acres at Hunters Point Shipyard and Candlestick Point, is arguing that it needs these additional 23 acres of prime waterfront property to build luxury condos, if the rest of its massive redevelopment plan is to pencil out.

Initially, SB 792 would have allowed the State to sell 43 acres of Candlestick Point State Recreation Area, the Bayview’s only major park, for condos. As such, it faced stiff opposition from the Sierra Club, Arc Ecology and Friends of Candlestick Point Park.

In its amended form, SB 792 authorizes the exchange of 23 acres, thus preserving 20 acres of existing parkland—a compromise, Leno says, that secured the neutrality of these three key environmental groups.

“I am especially pleased that after months of negotiations, amendments to SB 792 resulted in the neutrality of the Sierra Club, Arc Ecology and Friends of Candlestick Point,” Leno said.

So, what does SB 792’s passage mean for the park’s ecological integrity? And won’t the impact of removing 23 acres from the Bayview’s only major park be magnified, once condos and high rises have been built?

Ticonderoga pulls no revolutionary punches

PREVIEW There is literally something for everyone at this year’s 18th annual San Francisco Fringe Festival. Don’t try to argue, man — this year’s slate, which jams over 250 performances of over 40 experimental works by companies near and far into just under two weeks, is incredibly diverse. And though the old judging-a-book-by-its-cover cliché definitely applies to theater, some of the titles here are pretty irresistable: Hell, the Musical (inhabitants include a Valencia Street dyke and a Marina ditz); Spider Baby the musical (based on the 1968 movie subtitled The Maddest Story Ever Told? PREVIEW There is literally something for everyone at this year’s 18th annual San Francisco Fringe Festival. Mirant plant to close

GREEN CITY City Attorney Dennis Herrera’s office struck a deal with Mirant Potrero LLC on Aug. 13 to shutter its polluting Potrero power plant no later than Dec. 31, 2010. The settlement agreement represents a major victory for San Francisco and the broad array of elected officials and environmental-justice advocates who’ve been railing against the hazardous byproducts of the 40-year-old fossil fuel-fired facility for years.

The agreement also requires Mirant to pay the city $1 million, which will be put toward addressing childhood asthma and supporting neighborhood beautification.

"It’s a great result for the city, but in particular for the southeast sector," said Herrera, who has opposed the plant since 1999. "A lot of folks deserve a lot of credit for this."

Residents living in southeast San Francisco and Bayview-Hunter’s Point, where asthma rates are higher than average, have borne the brunt of toxic emissions spewing from the plant’s brick smokestack nearly 24 hours a day.

"It’s been a long haul," Sup. Sophie Maxwell, who represents the neighborhoods adversely affected by the pollution, said at a press conference. "Our community [has] some of the highest rates of asthma, the highest rates of cancer. We have babies being born in this community every day — and so we cannot keep our eye off the prize."

Maxwell’s vow to continue pushing even with the signed agreement in hand may prove wise considering that the California Independent System Operator (Cal-ISO) — a body that oversees the state’s power grid and determines capacity requirements — has yet to grant its blessing to the deal. Under the terms of the agreement, Mirant must declare to Cal-ISO that it will not continue operation beyond the shutdown date. The utility also agreed not to pursue renewal of its "reliability must-run" (RMR) contract with Cal-ISO, which has required the plant to run against the wishes of elected officials in San Francisco for years.

Cal-ISO left open the question of whether it would agree to release Mirant from the RMR requirement. "The ISO will continue to require local measures to be available at the level necessary to ensure that San Francisco reliability is consistent with that of other major metropolitan areas in California and the nation," spokesman Gregg Fishman noted in a statement.

The battle to shutter San Francisco’s dirty power plant might not be over — but for the first time Mirant will now be aligned with the city and at odds with Cal-ISO. "I’ve got to give credit where credit’s due," Herrera told the Guardian. "[Mirant] ultimately did step up here with the settlement and make an unprecedented commitment."

What’s in it for Mirant? The city attorney dropped a lawsuit against Mirant that sought compliance with codes requiring seismic upgrades to old brick buildings on the site. The city also will give priority to any redevelopment plans for the company-owned site.

Chip Little, a Mirant spokesperson, said the company doesn’t have a particular vision in mind. "At this time, we have no redevelopment plans for the site," he said. Mirant does have other projects in the works outside San Francisco, however. "We responded to a [request for offer] that PG&E issued last year for new capacity," Little told us. Mirant has applied for licenses to build a 930 MW natural gas-fired plant near Antioch, and a 550 MW natural gas-fired facility at the Pittsburg power plant site.

The TransBay Cable, an undersea power line that will transfer electricity from Pittsburg power sources to San Francisco, is expected to go live in March. The cable will negate the need for most of the electricity supplied by the 350 MW Potrero plant, but there will still be a 25 MW generation gap.

"That’s really a rather small amount," Ed Harrington, director of the San Francisco Public Utilities Commission, told reporters during the press conference. "We believe it could be met by underwriting other projects that PG&E is working on and by … cutting back when there’s a peak."

When a battle was waged last year over proposed construction of city-owned power plants to replace Mirant, many thought a solution that didn’t involve new in-city generation was impossible. One year later, this new accord with the City Attorney’s Office rests on the idea that shutting down Mirant with no new fossil fuel is not just possible, but within reach in the near future.

‘Can I buy your park?’

Saul Bloom, executive director of Arc Ecology, recently donned his best suit and a sandwich-board saying "Can I buy your park?" then headed to some of the city’s most popular open spaces: Dolores Park, Golden Gate Park, Crissy Field, and Ocean Beach.

Bloom’s quest? Pose as a developer and videotape reactions to a fictitious proposal to sell 25 percent of the parks for housing, a ruse designed to illuminate how the city and its master developer, Lennar Corp., have never been nearly that honest about their plan to get the state to sell 25 percent of Candlestick Point State Recreation Area so Lennar can build luxury condos on prime waterfront parklands.

Predictably, responses to Bloom’s poll were mainly negative, occasionally violent. "A couple of people tried to clock me over the head," Bloom recalled. "They got aggressive. They said ‘You’re an asshole, man.’ But the predominant reaction was ‘I love my park.’ People asked, ‘Why do you want to sell them?’ They feel there’s not enough open space."

Perhaps the most chilling response came when Bloom told folks about the city’s actual plan to build condos at Candlestick Point SRA in the Bayview District. "Their response was, ‘Oh, it’s in the Bayview? Who cares?’" said Bloom, who fears that apparent indifference to the plight of the Bayview may explain why the city and Lennar see Candlestick Point SRA as a development opportunity.

Arc isn’t the only group accusing Lennar and the city of not properly informing the public that a vote for Proposition G, which was billed as the "clean-up the shipyard initiative" during the June 2008 election, was also a vote to push Senate Bill 792, state tidelands legislation that authorizes the Candlestick Point sell-off.

Introduced by State Sen. Mark Leno in February, SB 792 has since been amended and approved by the full Senate and is currently scheduled for a hearing by the Assembly Appropriations Committee Aug. 19. Passage by the committee is virtually certain, given that it only delays legislation based on fiscal impacts.

But even some Prop. G supporters, including Bloom, are now raising questions about the deal.

San Francisco’s Park, Recreation, and Open Space Advisory Committee (PROSAC) unanimously approved a resolution recommending that the city’s Recreation and Park Commission and the sponsor of SB 792 require both the city and Lennar to "provide detailed accounting of the park and open space acreage in the Candlestick Project." The committee asks that no net open space in the region be lost in the transfer.

PROSAC claims it was in the dark about the deal and asked those who pushed Prop. G to "provide documentation of when PROSAC and any other relevant advisory committees were informed of the intention to purchase state parkland for the Candlestick Project." So far Lennar and the city have pointed to conceptual maps and a couple of notices of public meetings as evidence that the public was adequately informed before voting.

But according to Bloom, who studies the maps and attends the meetings, "There really is not anything other than two graphics, neither of which call out the alteration to the park boundary. You’d really have to know what you were looking for. And why would the city’s own advisory committee be asking Lennar and the city for information if they were in fact told of this plan?"

Adding fuel to the fire is a July 21 resolution by Sups. Chris Daly and John Avalos, which argues that it should be official policy of San Francisco to oppose SB 792 in its current form and remind city lobbyist Lynn Suter "to accurately represent the City and County of San Francisco policy in Sacramento."

The resolution has been assigned to the board’s Land Use Committee and likely won’t be heard until September. It contends that SB 792 is "premature and preempts the process for public input and environmental assessment since the environmental impact reports for the proposed development on Candlestick Point and the Hunters Point Shipyard will not be released until the fall of 2009."

Noting that the state "purchased this beautiful waterfront parkland for $10 million in 1977," Daly and Avalos assert that "this land represents a valuable and irreplaceable asset to the state of California that should not be disposed of for private development."

The resolution notes that many people oppose the transfer "because of the impact of environmental racism caused by selling a clean park to a private developer for condominium construction denying Bayview Hunters Point residents equal access to healthy open space as is enjoyed by other neighborhoods in San Francisco."

As Daly told the Guardian, "Everyone wants the shipyard site cleaned up, development that works for the community, and real open space opportunities on the shoreline. And Prop. G was billed as doing this, which led to a division of people who believed Lennar and those who didn’t."

As a result, Daly said, people like Saul Bloom, who supported Prop. G, are coming out against SB 792. "So now, it seems, the skeptics are right," Daly said. "A lot of promises have been made. But unless you get them in writing, and have an insurance policy, Lennar is not delivering."

But Lennar Communities of California, the developer’s major political action committee, seems to be delivering when it comes to advocating for the park sell-off. In the second quarter of this year, Lennar more than doubled its spending on lobbying, including on SB 792. And Aug. 3, it alerted its Prop. G supporters that help is needed "passing SB 792 through the California State Legislature."

The e-mail blast claims that SB 792 is "straightforward and necessary legislation that reconfigures the state park boundaries at Candlestick Point and exchanges under-utilized land (most of it dirt, rubble, and a parking lot) for tens of millions of dollars of needed new improvements to the state park and a steady stream of dedicated funding to operate and maintain the improved park and open space."

But recently, there has been talk of an SB 792 compromise. According to insiders, the city and Lennar are willing to concede 20 acres of the contested 42-acres of park, although the developer insists it needs to build hundreds of condos (of which only 15 percent will be below market rate) on the 22 remaining acres of state park land if its entire 700-acre development is to pencil out.

Privately, environmental advocates say they may be unable to stop the land grab. And they worry that seven of the 20 acres Lennar is prepared to concede could be inundated by rising seas caused by global warming, as shown in a 2007 study by engineering firm Moffat & Nichol. It would be an ironic fate given Mayor Gavin Newsom’s July 30 announcement of a proposed United Nations center focused on climate change and green technology as part of Lennar’s project.

The Sierra Club opposes selling state parklands, building a bridge over Yosemite Slough, and capping a radiologically-affected dump on the shipyard’s Parcel E2. But the club does not oppose Lennar’s entire redevelopment plan. Arthur Feinstein, the group’s local representative, said, "We’re interested in saving as much land as possible. We are pushing to save the park’s grasslands. It’s existing habitat."

Noting that some amendments to SB 792 have been made, including removing proposed exchanges of parklands for shipyard land, Feinstein said that "there’s now a map that defines the project and no longer carries shipyard land."

Michael Cohen, Newsom’s chief economic adviser, said, "At Leno’s request, we’ve made amendments to address concerns, including taking steps to ensure there is no adverse impact on wildlife habitat."

Cohen called Newsom’s United Nations Climate Center "the perfect institution" for the entire redevelopment project, since it provides the shipyard with a green technology anchor. Cohen said he was unaware of the study showing the area could be flooded by global warming.

"But no one disagrees," Cohen continued, "that the state park will benefit from infrastructure and much needed capital for operations and maintenance."

Leno told the Guardian that his goal is to arrive at the best possible bill. "At the request of the opposition, we did amend the bill so that land at Hunters Point Shipyard won’t be part of any exchange," Leno said. "But it is conceivable that once the cleanup is completed, there could be a gift from the city to the State Parks Commission."

Leno said he hadn’t seen the flood map and joked, "If someone thinks they know exactly where the water is going to stop, they can place some bets now."

Assuming a more serious tone, Leno added that "the entire park system is under threat." He recalled how Gov. Arnold Schwarzenegger proposed to eliminate all General Fund money for parks and said, "We fought back and were able to restore most of the money."

But with the state’s ongoing fiscal woes and political stalemate, "Anyone who believes CPRSA is going to be open and funded indefinitely is not thinking clearly … so this deal has the potential for being an opportunity for our taking responsibility for the future of our state park system."

As currently drafted, SB 792 provides millions for improvements and $700,000 annually for operations and maintenance, Leno explained. "So I’m trying to make a bad situation better in a way that brings along this bill’s opponents so that they see that they are being taken seriously."

Will Newsom get solar money back?

According to a somewhat confusing story in the Examiner, SolarCity, a private company that installs solar panels, collected the lion’s share of $9.5 million in city subsidies under a Newsom program to encourage private homeowners to put up the panels. To make the public subsidy palatable, SolarCity promised to build an academy in Bayview to train unemployed San Franciscans to move into this growing field.

But if the Ex is accurate, SolarCity has just backed out of that promise, and won’t be building the academy at all.

So I’m wondering: Will Newsom ask for the city money back?

Not so far. We checked with his always acerbic press secretary, Nathan Ballard, who gave us a typically terse reply: “I’m not sure what the facts are.”

Built around a colorful but humble lineup of players with nicknames like the Freak, Big Unit, and Kung Fu Panda, the current Giants roster is everything that Bonds was not — egoless, team-oriented, and free of baggage. And just as the Tim Lincecum-<\d>led pitching staff was shaping up as the team’s best asset for a successful playoff bid, along comes 26-year-old left-hander Jonathan Sanchez, from a demotion in the bullpen, to throw a masterpiece of a pitching performance. The Sanchez no-hitter against the Padres on July 10 was the team’s first since 1976. It provided an up-from-the-ashes victory that invoked tremendous optimism for the future, to the point where you can already hear it, clear with conviction and confidence: "Beat L.A.! Beat L.A.!"

BEST KID-FRIENDLY SUICIDE RUN

Never underestimate the urge — especially in somber, grizzle-haired grown-ups and perfectly sensible adults — to jam shiny, decal-stickered helmets on one’s head before shrieking downhill in plastic toy vehicles, playfully jockeying with others all the way to the bottom. Having just completed its triumphant ninth annual run this past Easter, the annual Bring Your Own Big Wheel race is spastic, daredevil fun. Any form of transport is legal, as long as it’s human-powered and about a third your size. Past races have seen some imaginative entries: office chairs figured in one racer’s wobbly run, while others constructed iffy rides from wood planks, masking tape, and a few ingeniously placed nails. Outlandish costumes never hurt, either: Big Bird, bunnies, and aliens run rampant. Once held on Lombard Street, the event now careens down Potrero Hill’s twistier Vermont Street. The only thing you can’t bring is alcohol. Shucks.

BEST WORKOUT WITH A TWIST

Is it wrong to be kind of turned on by the Victorian-bondage-looking machines at San Francisco Gyrotonic? Even the word "Gyrotonic" makes us gyrate suggestively in our minds. (Pervs!) Intimately connected to the dance community, the Gyrotonic exercise program is an intriguing new approach to working out. The Gyrotonic Expansion System was invented in the 1950s by ballet dancer Juliu Horvath after an Achilles injury left him unable to dance. The workout uses a contraption with raised pulleys, similar to a Pilates machine, but moves your joints in a circular rather than linear motion, training the body to be more flexible. Chevron has always been one of the Bay Area’s more vile corporations, whether it’s lobbying aggressively against global warming legislation or polluting communities from Richmond to Ecuador, all the while greenwashing its image with warm and fuzzy (and highly deceptive) advertising campaigns. That’s why we love to see groups such as the rainforest-protecting Amazon Watch and its anti-Chevron allies giving a little something back. Before this year’s Chevron shareholders meeting in San Francisco, activists plastered fake Chevron ads ("I will not complain about my asthma" and "I will give my baby contaminated water") all over the city and staged creative protests outside the event. Ditto when Chevron CEO David O’Reilly spoke at the Commonwealth Club in May, sending Chevron goons into a paranoid frenzy. Amazon Watch and other groups are winning some key battles — voters recently approved steep tax increases on Chevron’s Richmond refinery, and a judge rejected plans to expand the facility. To which we can only say, "Hit ’em again!"

BEST PUBLIC ACOUSTIC COCOON

Ear-piercing squeals, gut-rumbling skronks, the occasional wet fart sound — these are the unfortunate hallmarks of beginning brass instrumentalists. Those living in a city as dense and sensitive as our own have it rough when they want to work out their kinks: neighbors who sleep during the day or get up early yell at them, passersby take none too kindly to the squawking on busy sidewalks, and soundproofed studio space is economically out of reach. Little-known and charmingly miniscule, the Eagle Point Labyrinth is a jumble of twisty turns perched on the lip of a cliff near an offshoot of Lands End Trail. To reach it, you must set out with a compass in hand, hope in your heart, and fingers crossed. The labyrinth, one of three outdoor mazes known to exist in San Francisco, is a mysterious wonder that has so far avoided being marked on any map (although it can be glimpsed via a Google satellite image for those too faint to blindly wander in search of it). To be precise, the best place to hide a jet is behind Door 14 on the Alameda Naval Air Station. While many of the buildings on the former military base have been converted to civilian uses, such as sports clubs and distilleries, some continue to serve military functions, like storing the jet that used to be on display at the base’s portside entrance (until high winds blew it off its pedestal two winters ago). Remember the time the mayor’s office locked its door and sent out Wade Crowfoot to receive a copy from then school board member Eric Mar of the school board’s unanimous resolution that asked Newsom for a temporary shutdown of Lennar’s Bayview development until health testing could be done at the site? Crowfoot promised to “pass the message along to Newsom.”

Well, news is just in that Wade Crowfoot,who was appointed a couple of years ago as Newsom’s climate change initiative director, is headed for the Environmental Defense Fund.

And remember the time that Newsom’s budget director Nani Coloretti was left to face the press after Newsom made a shocking surprise visit to the Board of Supervisors to tell them that the budget was seriously messed up, then fled?

Well, news is just in that Coloretti, Newsom’s budget director, is going to be deputy assistant to the U.S. treasury secretary.

I don’t have any great pix or memories of political fundraiser Paige Barry Arata, but feel free to share them here, as news is also just in that Arata is quitting as the finance director of Newsom’s gubernatorial bid and returning to City Hall.

Arc Ecology’s ballsy Save our Park video: 2

Ten days ago, I posted about how the folks at Arc Ecology have put together a video appeal, on behalf of Candlestick Point State Recreation Area, in which they ask the California State legislature and the San Francisco Board of Supervisors to help save the Bayview’s only major piece of open space from greedy developers.

Today, I discovered that the Youtube link has since broken, hence this repost, with a link that works when you push the play button below:

What hasn’t changed is the content of the video, which explains how the city and developer Lennar plan to take 42 acres of a state park, which happens to be the only major piece of open space in the Bayview, and build mostly luxury condos on it.

Arc’s executive director Saul Bloom (the guy with the pony tail on the far right of the screen above) says his group will “certainly catch hell for doing this,” and definitely the content of the video is not designed to kiss ass. But like they say, a picture is worth a thousand or so words,so click on the link above, and take a look.

Big Rich’s Heart of the City (3 Story Muzik) is one of Ameoba’s top-selling hip-hop albums. "I feel like it’s a part of my responsibility to give back to my community," Rich says. "That’s why I call myself Fillmore Rich. It’s not to glamorize anything. It’s just that’s how I feel. All the people I grew up with, they ain’t here no more. I feel like it’s my responsibility to stay here and represent and help where I can. I am the only San Francisco rapper that still has a residence in the neighborhood where they grew up."

This Saturday, Rich will be there when the SF youth AIDS education organization Get Live Stay Live puts on an event at the Bayview Opera House. "There’s [been] a lot of friction going on with my area and Hunters Point," he says. "I’m going to show there ain’t no friction." Paving the way for privatization

City officials are considering shutting down the municipal asphalt plant — the source of material for repaving roads and fixing potholes — in order to facilitate construction of a private plant on the waterfront that the city would agree to help finance and support over the long term.

While the privatization plan is being billed by project proponents as a way to save money during tough financial times, it raises questions about whether relying on the private sector for this essential material could hurt the city’s ability to make emergency repairs and ultimately end up costing taxpayers even more.

For the cash-strapped Port of San Francisco, which will make millions of dollars leasing land for the new facility, this is unquestionably a good deal. But for the rest of the city, which is losing a potentially valuable public resource it has operated since 1909 when the first municipal plant opened, the answer is a bit less clear.

Douglas Legg, manager of finance and budget at the Department of Public Works (DPW), argues that the municipal plant is not cost-effective and that the city would pay less if it contracts with an outside vendor. In a 2006 study, Legg found that the city’s cost to produce a ton of asphalt was $75 while private plants offered it for $67.

"It’s true that E.B.I. Aggregates and Graniterock are a little cheaper because they have a market advantage: they own their own gravel quarries," admits Ben Santana, who has managed the municipal plant in the Bayview for the last 21 years. But he still thinks his facility plays an important role. "Otherwise they would have gotten rid of us long ago. We can mobilize in a few hours and city trucks don’t have to wait in line with other clients."

In the aftermath of the 1989 Loma Prieta earthquake, the municipal plant proved to be a valuable asset. "The plant wasn’t damaged. We sent our crews to take care of cracks and voids that had suddenly opened up," Santana recalls. "So the city didn’t have to go south to get material, or pay to get the private plants to open."

Indeed, in 2006, DPW held off the proposed shutdown in order to maintain its access to asphalt in emergencies. Officials worried about being dependant on plants outside city limits, especially since E.B.I. in Brisbane was slated to cease operations in the upcoming years, which would have left Graniterock potentially enjoying a monopoly that could result in price increases.

Although the agency recognizes that it has to have an asphalt plant inside city limits to function well, it is losing the political will to maintain its own. So when port officials approached DPW with their plan to attract a private asphalt operator, the threat to close down the municipal plant resurfaced.

The port has issued a request for proposal (RFP) for an asphalt-batching plant to be built on Pier 94. The selected bidder would be bound to negotiate a long-term contract with the city guaranteeing it would supply asphalt at a price tied to the Northern California asphalt price index.

The port and DPW assume the potential market for asphalt in the city will be large enough to draw private operators. But that belief seems to contradict the rationale behind the decision to close the municipal plant in the first place, which was that it couldn’t produce volumes large enough to bring the price per ton down.

"The demand from the street resurfacing program was nowhere near as high as we thought it would be," Legg says. In 2004, DPW installed two silos on the site to store hot asphalt and increase production. DPW was hoping to generate additional revenue for the department by selling asphalt to private contractors and other agencies. But two years later, Legg concluded in his report that the plant not only failed to turn a profit, it was facing a $100,000 shortfall to repay its investment.

Demand might be picking up, though: city officials expressed their intention to make up for years of neglect in the upkeep of San Francisco streets by introducing a $368 million safe street and road repair bond measure for the November ballot. The plan would boost the number of blocks to be resurfaced from 100 to 400 for the next 10 years, something that might make the city-owned plant more cost-effective. But Legg skeptically points out that the plant still requires replacement of some key components.

"Last year we had a $60 million capital budget for all capital improvement needs in the city from the general fund sources. This year, we’ve got $22 million," Legg says. "They’re scarce dollars. I can’t speak for what the Board [of Supervisors] will chose to do, but it’s challenging to get capital money."

Legg also noted the city plant’s "frequent breakdowns" and limited capacity to store raw materials, criticism countered by Santana. "The plant was modernized in 1993. Sure, some equipment does date to 1953, and I’ve been pushing to replace them for years. But it’s nothing the city can’t afford. Yes, it does sometimes go down. That’s part of operating a plant. But we’ve never run out of material because I always make sure to have some on ground or en route."

Brad Benson, project manager at the Port of San Francisco, discounts the recent limited asphalt consumption in the city, noting major development proposals in the city’s future. "Think about shipyard development, Treasure Island development, Caltrain, parking lots," Benson says. "If there’s not the demand, there won’t be bids. No one is going to invest $3 [million] to $10 million, whatever it costs to build an asphalt plant, if they don’t perceive a market."

But what might also hook prospective bidders is the provision, stated in the RFP, that the "risk capital to construct the facility (may be offset by city financing)." Benson explains that "this concept was introduced here in the midst of the financial crisis when people were having trouble finding sources of capital. The city may have access to some lower cost sources of debt."

Benson said he doesn’t know if city financing would be needed. "Obviously, the port prefers bidders that come in with their own sources of financing. That has been the model to build the neighboring concrete plants. The only reason to consider it is if the city combines lower-cost financing and could get lower cost asphalt in return. Then it might be worth doing."

It’s an interesting paradox: the city wouldn’t have funds to upgrade its plant, but would be ready to chip in to outsource?

But there are other issues driving the proposal. Karen Pierce, a Bayview- Hunters Point community activist who sits on the port’s Southern Waterfront Advisory Committee, told us she would "like to see the municipal plant move away from where people live. There needs to be a buffer area. A newer plant on port property would be further away, and we would have the opportunity to make sure it uses technologies that reduce the amount of pollution."

The municipal asphalt plant, which has never received complaints for pollution, currently incorporates 15 percent of recycled asphalt in its production. The RFP requests its potential tenant raise this amount up to 45 percent.

The proposed lot is also three times bigger than the existing one on Jerrold Avenue and has the advantage of being located near a maritime terminal where sand and gravel, the aggregates mixed with tar to produce asphalt, are imported. Also, there are two concrete batching plants and a construction material recycling center in the vicinity.

"Co-locating businesses that share each other’s products and reducing long-haul truck trips are the kernels of a broader idea for an ecoindustrial park that the port is developing in this area of the waterfront," Benson says.

If the asphalt plant project falls through, the port does have a backup plan: it is considering leasing the site to yet another concrete plant. Bids on both proposals are due in September, after which the Board of Supervisors will consider whether to close the city’s plant.

So, is the SFHA planning to file again, and if so, on what grounds?

Judge tosses Newsom’s political payback suits against Minister Muhammad

For several years, Minister Christopher Muhammad (at lectern) has been trying to get Mayor Gavin Newsom to temporarily stop work at the Hunters Point shipyard, until the children at Muhammad’s school and members of the surrounding Bayview community get asbestos dust-related health tests.

The city’s health department claims there is no health problem related to the dust and that there are no tests available, other than autopsies.
But thanks to Lennar’s failure to properly install and maintain air monitors, there is no data available to prove exactly what levels of dust the community was exposed to, when the developer’s massive grading project began at the shipyard in 2006.

Since then, air monitors at the site have repeatedly recorded exceedances that, the city claims, have triggered protective shutdowns, though often these shutdowns did not occur as fast as the community would like. And the ongoing exceedances have raised additional questions about the cumulative risk to public health and safety of all these dust clouds, where exactly the dust is coming from, and what exactly it contains.

Under new EPA administrator Lisa Jackson, the community’s request for additional assessments of the dust situation is reportedly being reviewed. But meanwhile, Muhammad’s refusal to shut up about the dust, has clearly angered Mayor Gavin Newsom, who recently said, via his spokesperson Nathan Ballard, that he supported a lawsuit that was filed against Muhammad and his group’s school, via the San Francisco Housing Authority, allegedly to recover unpaid back rent.

It was Chronicle columnists Phil Matier and Andy Ross who first asked whether the lawsuit that the San Francisco Housing Authority recently filed against Muhammad and the Nation of Islam’s Center for Self-Improvement, which operates the K-12 school next to the shipyard’s Parcel A in the Bayview, was “pay up or pay back”.

“You decide” the duo wrote on April 1, when they broke the news that the San Francisco Housing Authority had filed a lawsuit against Muhammad, alleging irregularities at the school, shortly after Muhammad and other activists showed up at Newsom’s gubernatorial town halls, asking loud and embarrassing questions about asbestos dust at the shipyard.

But the M&R column has remained deafeningly silent about the outcome of that lawsuit, even though Ross phoned the Nation of Islam’s lawyer Richard Drury minutes after the judge threw out not just one, but all three lawsuits that the SFHA had filed against Muhammad. That was over a week ago, on June 16.

So, does this mean the Chronicle only wants to write about stuff that they can spin to make Newsom look good and Muhammad bad? You decide.

It also turns out that it cost the city very little to file what appears to have been a series of frivolous lawsuits as payback for the Minister’s ongoing questions about asbestos dust: the city used in-house counsel at the Housing Authority, and the City is exempt from filing fees.

Reached by phone, Muhammad’s attorney Drury said he felt all three the lawsuits were “payback” against Muhammad for his attempts to try and get help from Newsom around ongoing issues with dust and asbestos at the shipyard.

“When the Minister didn’t get Newsom’s help, he attended a town hall meeting—and shortly afterwards, the San Francisco Housing Authority sued the Minister for breach of contract, payment of rent and unlawful detained,” Drury said. “In other words, the San Francisco Housing Authority is trying to evict a K-12 school, where 70 percent of the kids were failing in the public school system, and where 80 percent of the center’s graduates go to college.”

Selling the park

GREEN CITY Considering that it exists just a short hop from the industrial grind of Third Street, Candlestick Point State Recreation Area is a surprisingly wild and peaceful 150-acre bayshore park.

On a recent afternoon, a man practiced his golf swings, a group fished off a pier, and a lizard darted across a trail and into a clump of wildflowers, all apparently unaware of the storm gathering around the future of this waterfront habitat.

State Sen. Mark Leno’s Senate Bill 792 would give the State Lands Commission and State Parks Department the authority to negotiate an exchange of 42 acres in the park for patches of land on the former Hunters Point Naval Shipyard, allowing Lennar Corp. to build condos in the state park and reducing Bayview’s only major open space by 25 percent.

Leno claims that SB 792 "will help realize one of the few remaining opportunities for large-scale affordable housing, parks, open space, and economic development in San Francisco by authorizing a key public-private land exchange necessary for the development of Hunters Point/Candlestick Park."

"A lot of this property is dirt, and much of it is used by the 49ers for parking. It’s not high quality park land," Leno told the Guardian.

In addition to adding some amendments suggested by the Sierra Club, Leno said state and federal agencies must approve the deal, which would also require a full environmental impact report. "There will be no environmental shortcutting," Leno said.

But environmental advocates are outraged that Mayor Gavin Newsom and his chief economic advisor, Michael Cohen, are trying to get state legislators to facilitate an unpopular land swap that allows an out-of-state developer to build thousands of condos on state tidelands in exchange for strips and pockets of the toxic shipyard (see "Eliminating dissent," 6/17).

"When Michael Cohen asked us to endorse what they were calling a conceptual framework, he called it a rush to the starting line and promised us a full and robust discussion of the actual proposal," Kristine Enea, who works for the India Basin Neighborhood Association, said of last year’s Proposition G. "We’re not trying to stop the development, but we want a discussion. And we’re raising questions that otherwise won’t be raised until after the environmental impact report is completed."

In April, Newsom wrote to Sen. Fran Pavley, who chairs the state’s Senate Committee on Natural Resources and Water, claiming that plans for the shipyard and Candlestick Point had already been endorsed by the San Francisco Board of Supervisors and overwhelmingly approved by voters in June 2008.

"By utilizing a true public-private partnership, this [SB 792] will cause tens of millions of dollars of public open space investment to state park lands and public trust lands, at no cost to the state or the city’s general fund, providing a significant benefit to the state as well as to the citizens of San Francisco," Newsom wrote.

As part of the land swap, Lennar would pay fair market value for much of the parkland, with estimates of about $40 million that would go to the state for managing the remaining acreage. Lennar proposes to build 7,850 housing units on Candlestick Point, and it’s unclear how many of those will go into what is now a state park.

Critics say Newsom is trying to use Prop. G like a hammer to force through legislation that wouldn’t pass locally and would destroy the park’s current functions and wildlife habitat, forever changing life in Bayview Hunters Point, due to the scale and socioeconomic and environmental impacts of Lennar’s proposed redevelopment.

Created by the legislature in 1977, CPSRA is the state’s first urban park. It offers panoramic views of the wind-whipped bay, San Bruno Mountain, and Yosemite Slough, the only unbridged waterway in the city’s southeast sector. And while it’s not typically crowded, the park is well-used by residents, who like to hike and jog, walk their dogs, and windsurf adjacent to Monster Park stadium.

Saul Bloom — whose nonprofit group, Arc Ecology, angered Cohen and Newsom in February when it published "Alternatives for Study," a draft report that identified deficiencies in Lennar’s current proposal — admits that a section of the park is a weed-filled lot that 49ers fans use for parking on game days.

"But the leasing for parking contributes $800,000 toward park maintenance annually," Bloom told the Guardian, noting that this is a vital source of funding in tough times.

He also noted that the California State Parks Foundation recently raised $12 million to restore Yosemite Slough and the California Solid Waste Management Board (whose members include former Sen. Carole Migden, whom Leno defeated last year) recently completed a $1 million rehabilitation of a former construction debris field on the state park property.

But neither this nor the state Budget Conference Committee’s recent decision to institute a $15 surcharge on vehicle license fees of noncommercial vehicles as a dedicated funding source to keep California’s state parks open will save CPSRA from being hobbled if SB 792 is approved in its current state.

"Surely other land can be used for building condos. Affordable housing and condo residents need open space too," said Peter Barstow, founding director of Nature in the City, noting that the 42-acre parcel of contested land represents 25 percent of the park, but only 5 percent of the 770 acres the developer has at its disposal to build 10,500 units of proposed housing.

"Any loss in acreage would seriously diminish the ability of the park to serve the city’s needs, especially with 10,500 new units proposed for the Lennar development," Barstow said.

He said some "logical swapping" is possible. "But they are doing some numbers game, in which they are counting a huge amount of parkland that is already there."

"We should be thinking how to connect these ecologically isolated islands," Barstow said, who sees this debate as an opportunity to link CPSRA to wildlife corridors in McClaren Park and Bayview Hill. "The development should be in the interest of the people, critters, wildlife and plants in the Bayview, not in those of someone in an office thousands of miles away."

He also scoffed at proponents’ arguments that the density of the development means that it is smart urban growth. "Just because a development is dense is not an argument to build it on a park."

Cohen recently told the Guardian that the 77 acres of the 49ers stadium and all the paid parking inside its facility will be filled with "mainly retail and entertainment," while the 42 acres of state park would be used to build condos.

Meredith Thomas of the Neighborhood Parks Council noted that her group "fully supports the revitalization and redevelopment of the Candlestick Point/Shipyard area … But when folks voted for Prop. G in June 2008, nowhere did the measure say that by voting for it, you are agreeing to sell parkland."

"We are always concerned when municipal land that is being used as a park is put up for sale," Thomas said. "While it’s a state park, it really functions as a neighborhood park for those who use it. I think what happens when we plan for large developments is that we don’t do enough to plan for parks with the density increase that’s coming."

The Sierra Club has been leading the charge against the bill. "We lose 40 acres but gain a bathroom," Arthur Feinstein, the Sierra Club’s local representative jokingly told the Guardian. "Now that’s a good deal!"

Observing that the organization’s position is "no net loss of acreage, no loss of biodiversity, no loss of wildlife corridors," Feinstein said, "There are a ton of alternatives to this plan and no reason to destroy 25 percent of the park or build a bridge and a road over Yosemite Slough."

With Arc’s studies showing that the bridge, which will cost $100 million to construct, only shaves two minutes off travel time, Feinstein added: "This is a road to nowhere. It’ll cost $50 million a minute."

He also said that allowing a company to buy state parkland "sets a terrible precedent… Then every state park is at risk from developers as the state’s budget woes grow. I hope Sen. Mark Leno sees this."

"No one would ever think put housing on Crissy Field," Feinstein continued. "But in the Bayview, the attitude is, why not? That whole mentality has made the area into an environmental justice community. Even when it’s given something, it comes in a costly way to the community, but a cheap way for the developers."

Lennar’s shipyard: more toxic than you think

OPINION "So, what do you want us to do?"

That was the question from a staff member at the Bay Area Air Quality Management District (BAAQMD) after he passed along reports of Lennar Corp.’s latest repeated releases of toxic dust containing asbestos, arsenic, lead, and other metals into the air in Bayview-Hunters Point, one of the last remaining African American communities left in San Francisco.

After grudgingly levying more than $500,000 in fines against Lennar in 2008 for earlier brazen violations (after fierce community pressure), why is BAAQMD’s enforcement of clean-air standards against a notorious corporation on a dangerously toxic site still a negotiation?

After years of broken promises and half-hearted mitigation, the toxic partnership between the city and Lennar to develop the shipyard continues to threaten public resources and poison our communities in more ways than one.

In the last few months, with the help of the Mayor’s Office, Lennar is backing away from the promises it made in Proposition G. Instead of making 32 percent of its housing at the shipyard "affordable" to city residents (never mind that this definition of "affordable" is still well out of the reach of the great majority of Bayview residents), Lennar is now placing responsibility back on the city to build the affordable housing. As the Mayor’s Office prepares to use public money to subsidize Lennar’s broken promises, this revised arrangement blows a huge hole in the budget of the Mayor’s Office of Housing and threatens to destroy 30 years of efforts to create and preserve affordable housing elsewhere in the city.

As reported by Sarah Phelan last week ("Eliminating dissent," 6/17/09), state Sen. Mark Leno has legislation that seeks to trade 25 percent of Candlestick Point State Recreation Area for small strips on the shipyard so Lennar can build condos on the parkland (see "Selling the park" in this issue).

With the consent of City Hall, the Navy and Lennar continue to make deals in a backroom, with no public participation. The plan for development of the shipyard is getting even more toxic than you think, and its dangers threaten everyone in San Francisco.

That’s why a large coalition of grassroots organizations is joining forces for a community protest at the front gate of the Hunters Point Shipyard at 1 p.m. Tuesday, June 30. If the government won’t protect our communities from contamination and corporate greed, then we will do it ourselves.

Boxer wants to be shipyard clean-up’s “fair broker”

Sen. Barbara Boxer’s office forwarded me a letter yesterday that highlights Boxer’s concerns regarding the cleanup and redevelopment of Hunters Point Naval Shipyard.

“As Chair of the U.S. Senate Environment and Public Works committee, I am focused on protecting the health and environment of the Bay Area, including the Bayview Hunters Point community,” Boxer stated in the May 18, 2009 letter that she sent to Power’s Alicia Schwartz, who, incidentally won a Guardian’s Local Hero award in 2008, for working to improve the future of San Francisco’s black and working class communities.

Boxer’s letter landed after my deadline for this week’s story about the Navy dissolving the main body for community involvement in the shipyard clean-up, as that effort enters its most critical phase.

So, I’ve included her letter here, so folks can see what Boxer’s main concerns are. And also because it suggests that things may improve, at least in terms of working with the US Environmental Protection Agency, now that Lisa Jackson has taken the helm.

As Boxer writes, “Under Administrator Lisa Jackson, the EPA is returning to its mission of protecting American families and communities from environmental threats.”

Boxer’s communications director Zachary Coile told me today that as chair of the Senate Environment and Public Works Committee, Boxer has oversight of the US EPA, and wants to play the role of “fair broker” at the shipyard.
That sounds like a worthy goal. So, here’s hoping that Boxer can pull it off in a way that’s truly equitable.

Eliminating dissent

For years, the Hunters Point Shipyard Restoration Advisory Board has served as the Bayview-Hunters Point community’s main voice in the U.S. Navy’s environmental cleanup plans for the toxic former naval station. But the committee is suddenly being disbanded just as the cleanup enters a crucial phase.

Used for shipbuilding and submarine maintenance and repair, and the decontamination, storage, and disposal of radioactive and atomic weapons testing materials, the shipyard was added to the Superfund national toxic site cleanup list in 1989. But it is also at the heart of where Mayor Gavin Newsom has partnered with Lennar Corp. on the city’s biggest development proposal, involving 10,500 homes and a new stadium for the 49ers.

As the Navy prepares to release a series of important studies and reports concerning the cleanup of the dirtiest parcels on the former shipyard, community members were outraged by the Navy’s announcement in late May that it is preparing to dissolve the RAB in the next 30 days.

In July the Navy will release draft feasibility studies for the cleanup of Parcel E, along with a final remedial investigation/feasibility study for Parcel E2, the dirtiest parcel on the base, and a radiological data-gathering investigation in the sediment surrounding Parcel F, which is the underwater portion of the base.

Some insiders say the announcement was not unexpected, given an escautf8g series of confrontational RAB meetings with the Navy over the last two years. But they fear the community will lose its ability to give the Navy direct, timely, and meaningful feedback, even if many believe the Navy wasn’t listening.

"The Navy fully supports the need for open, meaningful dialogue with the diverse Bayview-Hunters Point community regarding our environmental cleanup actions and decisions. However, the RAB is not fulfilling this objective," the Navy’s Laura Duchnak wrote in a May 22 letter to the RAB.

In her letter, Duchnak said the RAB meetings no longer provide community input on the Navy’s environmental cleanup program, that their atmosphere is not productive to effective public discourse, and that Navy attempts to improve the process have failed. "The revised community involvement program may include community environmental forums, including using Internet-based technologies to more easily reach a diverse audience, expanded monthly progress reports and fact sheets, and hosting technical discussions and tours of cleanup sites for interested community members," Duchnak wrote.

Duchnak’s announcement followed a tense January meeting in which RAB members reacted with horror when the Navy announced it was moving forward with controversial plans to cap radiologically-affected areas on the shipyard’s Parcel B instead of digging and hauling them, which the community preferred (see "Nuclear Fallout," 07/16/08).

Led by RAB co-chair Leon Muhammad, who teaches at the Nation of Islam’s Center for Self Improvement, which has been repeatedly dusted by unmonitored asbestos (see "The corporation that ate San Francisco," 03/17/07), and joined by newly sworn-in members Archbishop King, Marie Harrison, and Daniel Landry, the board voted to seek a civil grand jury investigation into whether local truckers are getting their fair share of the Navy’s shipyard contracts.

Members then voted to remove the city’s public health representative Amy Brownell from the RAB, and to call for the stoppage of all work on the yard until the Department of Defense, the Navy, and the city can prove, as Muhammad said, "where the ongoing dust exceedences are coming from."

The final straw, insiders say, occurred in February when members voted to remove the Navy’s RAB co-chair Keith Forman from the advisory board. Eric Smith, who was sworn onto the RAB in January but did not vote to remove Brownell and Forman, said the Navy’s dissolution response wasn’t surprising.

"The dissolution of RAB is not a good thing in terms of what it is supposed to do. But it was also doing things that were dysfunctional," Smith said. "The bitter irony is that the folks who caused the trouble were trying to get the Navy to sit up and take notice."

Smith said there is frustration with the Navy’s communication style, which the community feels is patronizing. "But the RAB was naïve to think the Navy would allow a forum over which it has unilateral authority to become a platform for attacks," Smith said.

RAB member Kristine Enea, who missed the RAB’s last two meetings, confirmed that the atmosphere got increasingly confrontational but added that the Navy ignored suggestions her calls for wider community involvement.

"It’s ironic that the Navy had decided to respond to criticisms, which include the charge that it is a poor communicator, by cutting off communications with the community," said Enea, who works at the India Basin Neighborhood Association. "Dissolving the RAB is a drastic step. There is so much going on, and so much that we need to know."

But Enea hopes IBNA can help fill that void, noting that the association has applied for a US Environmental Protection Agency technical assistant grant to review shipyard clean-up documents, provide fact sheets, and host community meetings.

The Sierra Club’s Arthur Feinstein said that his group’s main concern around the dissolution is that Parcel E2, which contains an industrial and radiologically-impacted dump that burned for six months in 2000, and Parcel F are both coming up for analysis.

"These are some of the most significantly contaminated areas on the shipyard, so the timing is terrible," Feinstein told the Guardian, observing that some RAB members did not appear to be looking for solutions and were so aggressive they destroyed meetings.

"Unfortunately there weren’t enough forceful people to say ‘shut up and sit down,’" Feinstein said. "But without a RAB, there will be no public forum where folks are able to get and read materials ahead of the meeting, and then ask and submit questions."

Harrison, a member of the environmental justice group Green Action, believes the Navy’s intent is that there be no meaningful interaction with the community. "When you don’t toe the line and play like good little children, the Navy shuts you down," said Harrison, whose group, along with the Nation of Islam and the Caravan for Justice, are planning a June 30 demonstration at the shipyard to protest the move.

In another point of controversy, Sen. Mark Leno has legislation that seeks to trade 25 percent of Candlestick Point State Recreation Area, the only major piece of open space in the Bayview, for small strips on the shipyard so Lennar can build condos on the parkland.

Noting that Sen. Leland Yee and Assembly Members Tom Ammiano and Fiona Ma oppose the parks-for-condos plan (see "Going Nuclear," April 29), Harrison said, "What possessed anyone to believe that we’d say, okay, take the only open space in the Bayview, and in exchange we’ll accept contaminated land scattered around on the shipyard?"

Environmental advocates believe the Sierra Club intends to fight Leno’s legislation with a challenge under the California Environmental Quality Act, but Leno told the Guardian that he is "continuing to work and meet with the lobbyists for the Sierra Club here in Sacramento to see if there are any additional amendments we can take that would get them to a neutral position on the bill.

"I think there is a good possibility we can get there," Leno said.

In February, Arc Ecology released a 133-report titled "Alternatives for study" that recommended the removal of the Parcel E2 landfill and explored changes in land use arrangements in the current redevelopment proposal to avoid environmental impacts (see "Concrete Plans," Feb. 4). Unfortunately, they were largely ignored by the Mayor’s Office of Economic and Workforce Development, which is working with Lennar on the public-private development deal.

Arc Ecology executive director Saul Bloom remains undaunted, recalling how 87 percent of voters citywide supported Proposition P, an advisory measure he wrote and that then-Sups. Ammiano, Leno, Michael Yaki, and the late Sue Bierman placed on the ballot in 1989 to establish community acceptance criteria for the shipyard, under federal toxic cleanup guidelines.

"The Navy had offered their opinion that voters in San Francisco, and especially in the Bayview, would accept a nonresidential industrial level cleanup for the shipyard because they were primarily interested in jobs," Bloom recalled. "We said that this was a mischaracterization and we’d go ahead and prove them wrong."

He believes the current struggle with the Navy over the RAB, and with the city and Lennar over Arc’s alternatives, are "emblematic of the problem facing the Bayview with regard to accessing good information and being told the straight story on health and development issues."
