BARACK OBAMA


This is the most important presidential election of our lives.

The nation is in a state of political and financial meltdown. The war in Iraq drags on, sucking money out of the US Treasury and costing more and more lives. The gap between the rich and the poor has risen to unsustainable levels, global warming threatens to permanently alter the ecology of the globe … and all the Republican candidate offers is more of the same. It’s scary.

The Democrat we proudly endorsed in the California primary isn’t the exact same candidate who’s trying to get elected president today. Barack Obama, like just about all Democrats at this stage of a campaign, has moved a bit to the right. He supported the $700 million Wall Street bailout that’s essentially a huge giveaway to the same people who caused the problem. He talks about promoting "safe nuclear energy" and "clean coal" — oxymora if there ever were any.

Back in February, we noted that "our biggest problem with Obama is that he talks as if all the nation needs to do is come together in some sort of grand coalition of Democrats and Republicans, of ‘blue states and red states.’ But some of us have no interest in making common cause with the religious right or Dick Cheney or Halliburton or Don Fisher. There are forces and interests in the United States that need to be opposed, defeated, consigned to the dustbin of history, and for all of Obama’s talk of unity, we worry that he lacks the interest in or ability to take on a tough, bloody fight against an entrenched political foe."

But Obama remains one of the most inspirational candidates for high office we’ve ever seen. He’s energized a generation of young voters, he’s electrified communities of color, and he’s given millions of Americans a chance to hope that Washington can once again be a friend, not an enemy, to progressive values at home and abroad.

His tax proposals are pretty good. He’s always been against the war. His health care plan isn’t perfect, but it’s at least a step toward universal coverage.

And frankly, the nation can’t afford another four years of Bush-style policies.

The election is a turning point for the United States. It’s about a movement that can change the direction of the country; it’s about mobilizing people in large numbers to reject the failed right-wing policies of Bush and the Republican Party. We’re pleased to endorse Barack Obama as the standard-bearer of that movement.

Congress, District 6

LYNN WOOLSEY


Lynn Woolsey comes from the more moderate suburbs, and she’s far better than Nancy Pelosi, who represents liberal San Francisco. Just look at the bailout: Pelosi wants to prop up the Wall Street banks, and Woolsey wanted to fund any bailout with a modest tax on risky financial instruments. Woolsey richly deserves reelection.

GEORGE MILLER


George Miller, who has represented this East Bay district since 1974, is an effective legislator and strong environmentalist. Sometimes he’s too willing to compromise — he worked with the George W. Bush administration on No Child Left Behind, a disaster of an education bill — but he’s a solid opponent of the war, and we’ll endorse him for another term.

Congress District 8

CINDY SHEEHAN


The antiwar leader and Gold Star mom who put George Bush on the defensive is at best a long shot to unseat the Speaker of the House. Cindy Sheehan has only recently moved to the district, has no local political experience, and is taking on one of the most powerful politicians in the United States.

But we can’t endorse Nancy Pelosi, who has consistently supported funding the war (and has refused to meet with antiwar protesters camped out in front of her house). Pelosi pushed the Wall Street bailout and privatized the Presidio.

Sheehan wants a fast withdrawal from Iraq, opposes any bailout for the big financial institutions, and is a voice against business as usual in Congress. This is a protest vote, but a valid one.

Congress, District 13

PETE STARK


After 32 years, Pete Stark has become in some ways the most radical member of the Bay Area congressional delegation. He’s furious with the war and shows no patience for the Bush administration’s nonsense. He is the only member of Congress who admits he’s an atheist. We just hope he doesn’t decide to retire any time soon.

GERARDO SANDOVAL


It’s unusual to see contested races for judge in San Francisco. Most of the time, incumbents retire midterm to allow the governor to appoint a replacement, and almost nobody ever challenges a sitting judge. So the San Francisco bench has been shaped more by Republican governors than by the overwhelmingly Democratic electorate.

So we were pleased to see Gerardo Sandoval, a termed-out supervisor and former public defender, file to run against Judge Thomas Mellon. A conservative Republican appointed by Gov. Pete Wilson in 1994, Mellon has a lackluster record, at best. California Courts and Judges, a legal journal, calls him unreasonable and cantankerous. In 2000, the San Francisco Public Defender’s Office sought to have him removed from all criminal cases because of his anti-defendant bias. He needed a challenge, and he’s got one: in the June primary, Sandoval came in well ahead, but because there were three candidates, this contest has gone to a November runoff.

Sandoval has been a generally progressive member of the Board of Supervisors, although we were critical of some of his votes. But he would bring the perspective of a public defender to a bench dominated by former prosecutors and big-firm civil lawyers. Vote for Sandoval.

STATE RACES

State Senate, District 3

MARK LENO


The drama in this race took place back in June, when Leno beat incumbent Carole Migden and former Marin Assemblymember Joe Nation in the Democratic primary. Like most Bay Area Democrats, he’s a shoo-in for the general election. But it’s worth noting that Leno has an extensive record in the Assembly and has demonstrated an ability to get things done. Long before the Supreme Court made same-sex marriage the law of the state, Leno got both houses of the Legislature to approve marriage equality bills (which the governor then vetoed). He got the Ellis Act, that terrible law that allows landlords to evict all their tenants and sell their buildings as condos, amended to protect seniors and disabled people. And while we were worried in the spring that Leno might be too close to Mayor Newsom when it came to local endorsements, he’s shown both independence and progressive leanings. He has been a strong, visible and effective backer of Prop. H, the Clean Energy Act and has endorsed Mark Sanchez for supervisor in District 9, breaking with Newsom (and the moderates) who backed Eva Royale. We expect Leno will go on to a stellar record in the state Senate and we’re happy to endorse him.

State Senate, District 9

LONI HANCOCK


A part of Berkeley politics since she first ran successfully for city council in 1971, Lori Hancock has spent the past six years in the State Assembly. She defeated Wilma Chan in a heated primary for this State Senate seat and faces little opposition in November. She’s one of the most experienced progressives in California and has a solid grip on the state’s budget issues. We wish she wasn’t so willing to back more moderate candidates for local office, but we’re happy to see her move up to the senate.

FIONA MA


Fiona Ma has been a pleasant surprise. We didn’t support her for this post two years ago, but she’s become a leading advocate of high-speed rail, a foe of plans to privatize the Cow Palace, and a visible, out-front backer of the Clean Energy Act. We hope she continues to evolve into a progressive leader in Sacramento.

State Assembly, District 13

TOM AMMIANO


The only problem with Tom Ammiano moving up to Sacramento is that we’ll miss his presence at City Hall. Ammiano’s record is stellar — although he was once nearly a lone voice for progressives on the Board of Supervisors, he’s become one of its most effective members, with a long list of groundbreaking legislation. Ammiano authored the city’s domestic partners law. He created Healthy San Francisco, the universal health care program. He sponsored the 2001 and 2002 public power measures. He created the Children’s Fund and the Rainy Day Fund, which is now saving programs in the public schools.

He’s also responsible — as much as any one person ever can be — for dramatically changing the climate of San Francisco politics. Ammiano’s 1999 mayoral challenge to incumbent Willie Brown brought the progressives together in ways we hadn’t seen in years, and the district-elections measure Ammiano authored brought a completely new Board of Supervisors into office a year later.

We’re happy to see Ammiano move on to Sacramento.

State Assembly, District 14

NANCY SKINNER


Nancy Skinner won the June primary for this seat, and while we supported her opponent, Kriss Worthington, we acknowledged that she would make an excellent assembly member. Skinner has plenty of experience: she was on the Berkeley City Council from 1984 to 1992 and has founded and run a nonprofit that helps cities establish sustainable environmental policies. She understands state budget issues, is a strong advocate for education, and will hit the ground running.

Project Censored

The daily dispatches and nightly newscasts of the mainstream media regularly cover terrorism, but rarely discuss how the fear of attacks is used to manipulate the public and set policy. That’s the common thread of many unreported stories last year, according to an analysis by Project Censored.

Since 1976, Sonoma State University has released an annual survey of the top 25 stories the mainstream media failed to report or reported poorly. Culled from worldwide alternative news sources, vetted by students and faculty, and ranked by judges, the stories were not necessarily overtly censored. But their controversial subjects, challenges to the status quo, or general under-the-radar subject matter might have kept them from the front pages. Project Censored recounts them, accompanied by media analysis, in a book of the same name published annually by Seven Stories Press.

"This year, war and civil liberties stood out," Peter Phillips, project director since 1996, said of the top stories. "They’re closely related and part of the War on Terror that has been the dominant theme of Project Censored for seven years, since 9/11."

Whether it’s preventing what one piece of legislation calls "homegrown terrorism" by federally funding the study of radicalism, using vague concerns about security to quietly expand NAFTA, or refusing to count the number of Iraqi civilians killed in the war, the threat of terrorism is being used to silence people and expand power.

"The war on terror is a sort of mind terror," said Nancy Snow, one of the project’s 24 judges and an associate professor of public diplomacy at the Newhouse School of Public Communications at Syracuse University. Snow — who has taught classes on war, media, and propaganda — elaborated: "You can’t declare war on terror. It’s a tactic used by groups to gain publicity and it will remain with us. But it’s unlikely that [the number of terrorist acts] will spike. It spikes in the minds of people."

She pointed out that the number of terrorist attacks has dropped worldwide since 2003. Some use the absence of fresh attacks as evidence that the so-called war on terror is working. But a RAND Corporation study for the Department of Defense released in August said the war on terror hasn’t effectively undermined Al Qaeda. It suggested the phrase be replaced with the less loaded term "counterterrorism."

Both Phillips and Snow agree that comprehensive, contextual reporting is missing from most of the coverage. "That’s one of my criticisms of the media," Snow said. "They spotlight issues and don’t look at the entire landscape."

This year the landscape of Project Censored itself is expanding. After talking with educators who bemoan the ongoing decline of news quality and want to help, Phillips launched the Truth Emergency Project, in which Sonoma State partners with 23 other universities. All will host classes for students to search out untold stories, vet them for accuracy, and submit them for consideration to Project Censored.

"There’s a renaissance of independent media," Phillips said. He thinks bloggers and citizen journalists are filling crucial roles left vacant by staff cutbacks throughout the mainstream media. And, he said, it’s time for universities, educators, and media experts to step in and help. "It’s not just reforming the media, but supporting them in as many ways as they need, like validating stories by fact-checking."

The Truth Emergency Project will also host a news service that aggregates the top 12 independent media sources and posts them on one page. "So you can get an RSS feed from all the major independent news sources we trust," he said. Discerning newshounds can find reporting from the BBC, Democracy Now!, and Inter Press Service (IPS) in one spot. "The whole criteria," he said, "is no corporate media."

Carl Jensen, who started Project Censored in 1976, said the expansion is a new and necessary phase. "It answers the question I was always challenged with: how do you know this is the truth? Having 24 campuses reviewing all the stories and raising questions really provides a good answer. These stories will be vetted more than Sarah Palin."

Phillips said he hopes to expand to 100 schools within the year, and would like the project to bring more attention to the dire need for public support for high quality news reporting. "I think it’s going to require government subsidies and nonprofit organizations doing community media projects," he said. "It’s more than just reforming at the FCC level. It’s building independent media from the ground up."

Phillips likens it to the boom in microbrewed beer and the spread of independently-owned pubs: "If we can have a renaissance in beer-making, following established purity standards, then we can do it with our media, too." But for now, we have Project Censored, whose top 10 underreported stories for 2008 are:

1. HOW MANY IRAQIS HAVE DIED?


Nobody knows exactly how many lives the Iraq War has claimed. But even more astounding is that so few journalists have mentioned the issue or cited the top estimate: 1.2 million.

During August and September 2007, Opinion Research Business, a British polling group, surveyed 2,414 adults in 15 of 18 Iraqi provinces and found that more than 20 percent had experienced at least one war-related death since March 2003. Using common statistical study methods, it determined that as many as 1.2 million people had been killed since the war began.

The US military, claiming it keeps no count, still employs civilian death data as a marker of progress. For example, in a Sept. 10, 2007, report to Congress, Gen. David Petraeus said, "Civilian deaths of all categories, less natural causes, have also declined considerably, by over 45 percent Iraq-wide since the height of the sectarian violence in December."

But whose number was he using? Estimates range wildly and are based on a variety of sources, including hospital, morgue, and media reports, as well as in-person surveys.

In October 2006, the British medical journal Lancet published a Johns Hopkins University study vetted by four independent sources that counted 655,000 dead, based on interviews with 1,849 households. It updated a similar study from 2004 that counted 100,000 dead. The Associated Press called it "controversial."

The AP began its own count in 2005 and by 2006 said that at least 37,547 Iraqis had lost their lives due to war-related violence, but called it a minimum estimate at best and didn’t include insurgent deaths.

Iraq Body Count, a group of US and UK citizens who aggregate numbers from media reports on civilian deaths, puts the figure between 87,000 and 95,000. In January 2008, the World Health Organization and the Iraqi government did door-to-door surveys of nearly 10,000 households and put the number of dead at 151,000.

The 1.2 million figure is out there, too, which is higher than the Rwandan genocide death toll and closing in on the 1.7 million who perished in Cambodia’s killing fields. It raises questions about the real number of deaths from US aerial bombings and house raids, and challenges the common assumption that this is a war in which Iraqis are killing Iraqis.

Justifying the higher number, Michael Schwartz, writing on the blog AfterDowningStreet.org, pointed to a fact reported by the Brookings Institute that US troops have, over the past four years, conducted about 100 house raids a day — a number that has recently increased with assistance from Iraqi soldiers.

Brutality during these house searches has been documented by returning soldiers, Iraqi civilians, and independent journalists (See #9 below). Schwartz suggests the aggressive "element of surprise" tactics employed by soldiers is likely resulting in several thousands of deaths a day that either go unreported or are categorized as insurgent casualties.

The spin is having its intended effect: a February 2007 AP poll showed Americans gave a median estimate of 9,890 Iraqi deaths as a result of the war, a number far below that cited in any credible study.

2. NAFTA ON STEROIDS


Coupling the perennial issue of security with Wall Street’s measures of prosperity, the leaders of the three North American nations convened the Security and Prosperity Partnership. The White House–led initiative — launched at a March 23, 2005, meeting of President Bush, Mexico’s then-president Vicente Fox, and Canadian Prime Minister Paul Martin — joins beefed-up commerce with coordinated military operations to promote what it calls "borderless unity."

Critics call it "NAFTA on steroids." However, unlike NAFTA, the SPP was formed in secret, without public input.

"The SPP is not a law, or a treaty, or even a signed agreement," Laura Carlsen wrote in a report for the Center for International Policy. "All these would require public debate and participation of Congress, both of which the SPP has scrupulously avoided."

Instead the SPP has a special workgroup: the North American Competitiveness Council. It’s a coalition of private companies that are, according to the SPP Web site, "adding high-level business input [that] will assist governments in enhancing North America’s competitive position and engage the private sector as partners in finding solutions."

The NACC includes the Chevron Corporation, Ford Motor Company, General Electric, Lockheed Martin Corporation, Merck & Co. Inc., New York Life Insurance Co., Procter & Gamble Co., and Wal-Mart Stores, Inc.

"Where are the environmental council, the labor council, and the citizen’s council in this process?" Carlsen asked.

A look at NAFTA’s unpopularity among citizens in all three nations is evidence of why its expansion would need to be disguised. "It’s a scheme to create a borderless North American Union under US control without barriers to trade and capital flows for corporate giants, mainly US ones," wrote Steven Lendman in Global Research. "It’s also to insure America gets free and unlimited access to Canadian and Mexican resources, mainly oil, and in the case of Canada, water as well."

3. INFRAGARD GUARDS ITSELF


The FBI and Department of Homeland Security have effectively deputized 23,000 members of the business community, asking them to tip off the feds in exchange for preferential treatment in the event of a crisis. "The members of this rapidly growing group, called InfraGard, receive secret warnings of terrorist threats before the public does — and, at least on one occasion, before elected officials," Matthew Rothschild wrote in the March 2008 issue of The Progressive.

InfraGard was created in 1996 in Cleveland as part of an FBI probe into cyberthreats. Yet after 9/11, membership jumped from 1,700 to more than 23,000, and now includes 350 of the nation’s Fortune 500 companies. Members typically have a stake in one of several crucial infrastructure industries, including agriculture, banking, defense, energy, food, telecommunications, law enforcement, and transportation. The group’s 86 chapters coordinate with 56 FBI field offices nationwide.

While FBI Director Robert Mueller has said he considers this segment of the private sector "the first line of defense," the American Civil Liberties Union issued a grave warning about the potential for abuse. "There is evidence that InfraGard may be closer to a corporate TIPS program, turning private-sector corporations — some of which may be in a position to observe the activities of millions of individual customers — into surrogate eyes and ears for the FBI," it cautioned in an August 2004 report.

"The FBI should not be creating a privileged class of Americans who get special treatment," Jay Stanley, public education director of the ACLU’s technology and liberty program, told Rothschild.

And they are privileged: a DHS spokesperson told Rothschild that InfraGard members receive special training and readiness exercises. They’re also privy to protected information that is usually shielded from disclosure under the trade secrets provision of the Freedom of Information Act.

The information they have may be of critical importance to the general public, but first it goes to the privileged membership — sometimes before it’s released to elected officials. As Rothschild related in his story, on Nov. 1, 2001, the FBI sent an alert to InfraGard members about a potential threat to bridges in California. Barry Davis, who worked for Morgan Stanley, received the information and relayed it to his brother Gray, then governor of California, who released it to the public.

Steve Maviglio, Davis’s press secretary at the time, told Rothschild, "The governor got a lot of grief for releasing the information. In his defense, he said, ‘I was on the phone with my brother, who is an investment banker. And if he knows, why shouldn’t the public know?’<0x2009>"

4. ILEA: TRAINING GROUND FOR ILLEGAL WARS?


The School of the Americas earned an unsavory reputation in Latin America after many graduates of the Fort Benning, Ga., facility turned into counterinsurgency death squad leaders. So the International Law Enforcement Academy recently installed by the Unites States in El Salvador — which looks, acts, and smells like the SOA — is also drawing scorn.

The school, which opened in June 2005 before the Salvadoran National Assembly approved it, has a satellite operation in Peru and is funded with $3.6 million from the US Treasury and staffed with instructors from the DEA, ICE, and FBI. It’s tasked with training 1,500 police officers, judges, prosecutors, and other law enforcement agents in counterterrorism techniques per year. It’s stated purpose is to make Latin America "safe for foreign investment" by "providing regional security and economic stability and combating crime."

ILEAs aren’t new, but past schools located in Hungary, Thailand, Botswana, and Roswell, N.M., haven’t been terribly controversial. Yet Salvadoran human rights organizers take issue with the fact that, in true SOA fashion, the ILEA releases neither information about its curriculum nor a list of students and graduates. Additionally, the way the school slipped into existence without public oversight has raised ire.

As Wes Enzinna noted in a North American Congress on Latin America report, when the US decided it wanted a training ground in Latin America, El Salvador was not the first choice. In 2002 US officials selected Costa Rica as host — a country that doesn’t even have an army. The local government signed on and the plan made headlines. But when citizens learned about it, they revolted and demanded the government change the agreement. The US bailed for a more discreet second attempt in El Salvador.

"Members of the US Congress were not briefed about the academy, nor was the main opposition party in El Salvador, the Farabundo Martí-National Liberation Front (FMLN)," Enzinna wrote. "But once the news media reported that the two countries had signed an official agreement in September, activists in El Salvador demanded to see the text of the document." Though they tried to garner enough opposition to kill the agreement, the National Assembly narrowly ratified it.

Now, after more than three years in operation, critics point out that Salvadoran police, who account for 25 percent of the graduates, have become more violent. A May 2007 report by Tutela Legal implicated Salvadoran National Police (PNC) officers in eight death squad–style assassinations in 2006.

El Salvador’s ILEA recently received another $2 million in US funding through the congressionally approved Mérida Initiative — but still refuses to adopt a more transparent curriculum and administration, despite partnering with a well-known human rights leader. Enzinna’s FOIA requests for course materials were rejected by the government, so no one knows exactly what the school is teaching, or to whom.

5. SEIZING PROTEST


Protesting war could get you into big trouble, according to a critical read of two executive orders recently signed by President Bush. The first, issued July 17, 2007, and titled, "Blocking property of certain persons who threaten stabilization efforts in Iraq," allows the feds to seize assets from anyone who "directly or indirectly" poses a risk to the US war in Iraq. And, citing the modern technological ease of transferring funds and assets, the order states that no prior notice is necessary before the raid.

On Aug. 1, Bush signed another order, similar but directed toward anyone undermining the "sovereignty of Lebanon or its democratic processes and institutions." In this case, the Secretary of the Treasury can seize the assets of anyone perceived as posing a risk of violence, as well as the assets of their spouses and dependents, and bans them from receiving any humanitarian aid.

Critics say the orders bypass the right to due process and the vague language makes manipulation and abuse possible. Protesting the war could be perceived as undermining or threatening US efforts in Iraq. "This is so sweeping, it’s staggering," said Bruce Fein, a former Reagan administration official in the Justice Department who editorialized against it in the Washington Times. "It expands beyond terrorism, beyond seeking to use violence or the threat of violence to cower or intimidate a population."

6. RADICALS = TERRORISTS


On Oct. 23, 2007, the House of Representatives overwhelmingly passed — by a vote of 404-6 — the "Violent Radicalization and Homegrown Terrorism Prevention Act," designed to root out the causes of radicalization in Americans.

With an estimated four-year cost of $22 million, the act establishes a 10-member National Commission on the Prevention of Violent Radicalization and Homegrown Terrorism, as well as a university-based Center of Excellence "to examine the social, criminal, political, psychological, and economic roots of domestic terrorism," according to a press release from the bill’s author, Rep. Jane Harman (D-Los Angeles).

During debate on the bill, Harman said, "Free speech, espousing even very radical beliefs, is protected by our Constitution. But violent behavior is not."

Jessica Lee, writing in the Indypendent, a newspaper put out by the New York Independent Media Center, pointed out that in a later press release Harman stated: "the National Commission [will] propose to both Congress and [Department of Homeland Security Secretary Michael] Chertoff initiatives to intercede before radicalized individuals turn violent."

Which could be when they’re speaking, writing, and organizing in ways that are protected by the First Amendment. This redefines civil disobedience as terrorism, say civil rights experts, and the wording is too vague. For example, the definition of "violent radicalization" is "the process of adopting or promoting an extremist belief system for the purpose of facilitating ideologically based violence to advance political, religious, or social change."

"What is an extremist belief system? Who defines this? These are broad definitions that encompass so much…. It is criminalizing thought and ideology," said Alejandro Queral, executive director of the Northwest Constitutional Rights Center in Portland, Ore.

Though the ACLU recommended some changes that were adopted, it continued to criticize the bill. Harman, in a response letter, said free speech is still free and stood by the need to curb ideologically-based violence.

The story didn’t make it onto the CNN ticker, but enough independent sources reported on it that the equivalent Senate Bill 1959 has since stalled. After introducing the bill, Sen. Susan Collins (R-Me.), later joined forces with Sen. Joe Lieberman (I-Conn.) on a report criticizing the Internet as a tool for violent Islamic extremism.

Despite an outcry from civil liberties groups, days after the report was released Lieberman demanded that YouTube remove a number of Islamist propaganda videos. YouTube canned some that broke their rules regarding violence and hate speech, but resisted censoring others. The ensuing battle caught the attention of the New York Times, and on May 25 it editorialized against Lieberman and S 1959.

7. SLAVERY’S RUNNER-UP


Every year, about 121,000 people legally enter the United States to work with H-2 visas, a program legislators are touting as part of future immigration reform. But Rep. Charles Rangel (D-N.Y.) called this guest worker program "the closest thing I’ve ever seen to slavery."

The Southern Poverty Law Center likened it to "modern day indentured servitude." They interviewed thousands of guest workers and reviewed legal cases for a report released in March 2007, in which authors Mary Bauer and Sarah Reynolds wrote, "Unlike US citizens, guest workers do not enjoy the most fundamental protection of a competitive labor market — the ability to change jobs if they are mistreated. Instead, they are bound to the employers who ‘import’ them. If guest workers complain about abuses, they face deportation, blacklisting, or other retaliation."

When visas expire, workers must leave the country, hardly making this the path to permanent citizenship legislators are looking for. The H-2 program mimics the controversial bracero program, established through a joint agreement between Mexico and the United States in 1942 that brought 4.5 million workers over the border during the 22 years it was in effect.

Many legal protections were written into the program, but in most cases they existed only on paper in a language unreadable to employees. In 1964 the program was shuttered amid scores of human rights abuses and complaints that it undermined petitions for higher wages from US workers. Soon after, United Farm Workers organized, which César Chávez said would have been impossible if the bracero program still existed.

Years later, it essentially still does. The H-2A program, which accounted for 32,000 agricultural workers in 2005, has many of the same protections — and many of the same abuses. Even worse is the H-2B program, used by 89,000 non-agricultural workers annually. Created by the Immigration Reform and Control Act of 1986, none of the safeguards of the H-2A visa are legally required for H-2B workers.

Still, Mexicans are literally lining up for H-2B status, the stark details of which were reported by Felicia Mello in The Nation. Furthermore, thousands of illegal immigrants are employed throughout the country, providing cheap, unprotected labor and further undermining the scant provisions of the laws. Labor contractors who connect immigrants with employers are stuffing their pockets with cash, while the workers return home with very little money.

The Southern Poverty Law Center outlined a list of comprehensive changes needed in the program, concluding, "For too long, our country has benefited from the labor provided by guest workers but has failed to provide a fair system that respects their human rights and upholds the most basic values of our democracy. The time has come for Congress to overhaul our shamefully abusive guest worker system."

8. BUSH CHANGES THE RULES


The Bush administration’s Office of Legal Counsel in the Department of Justice has been issuing classified legal opinions about surveillance for years. As a member of the Senate Intelligence Committee, Sen. Sheldon Whitehouse (D-R.I.) had access to the DOJ opinions on presidential power and had three declassified to show how the judicial branch has, in a bizarre and chilling way, assisted President Bush in circumventing its own power.

According to the three memos:

"There is no constitutional requirement for a President to issue a new executive order whenever he wishes to depart from the terms of a previous executive order. Rather than violate an executive order, the President has instead modified or waived it";

"The President, exercising his constitutional authority under Article II, can determine whether an action is a lawful exercise of the President’s authority under Article II," and

"The Department of Justice is bound by the President’s legal determinations."

Or, as Whitehouse rephrased in a Dec. 7, 2007, Senate speech: "I don’t have to follow my own rules, and I don’t have to tell you when I’m breaking them. I get to determine what my own powers are. The Department of Justice doesn’t tell me what the law is. I tell the Department of Justice what the law is."

The issue arose within the context of the Protect America Act, which expands government surveillance powers and gives telecom companies legal immunity for helping. Whitehouse called it "a second-rate piece of legislation passed in a stampede in August at the behest of the Bush administration."

He pointed out that the act does not prohibit spying on Americans overseas — with the exception of an executive order that permits surveillance only of Americans whom the Attorney General determines to be "agents of a foreign power."

"In other words, the only thing standing between Americans traveling overseas and government wiretap is an executive order," Whitehouse said in an April 12 speech. "An order this president, under the first legal theory I cited, claims he has no legal obligation to obey."

Whitehouse, a former US Attorney, legal counsel to Rhode Island’s governor, and Rhode Island Attorney General who took office in 2006, went on to point out that Marbury vs. Madison, written by Chief Justice John Marshall in 1803, established that it is "emphatically the province and duty of the judicial department to say what the law is."

9. SOLDIERS SPEAK OUT


Hearing soldiers recount their war experiences is the closest many people come to understanding the real horror, pain, and confusion of combat. One would think that might make compelling copy or powerful footage for a news outlet. But in March, when more than 300 veterans from the wars in Iraq and Afghanistan convened for four days of public testimony on the war, they were largely ignored by the media.

Winter Soldier was designed to give soldiers a public forum to air some of the atrocities they witnessed. Originally convened by Vietnam Vets Against the War in January 1971, more than 100 Vietnam veterans and 16 civilians described their war experiences, including rapes, torture, brutalities, and killing of non-combatants. The testimony was entered into the Congressional Record, filmed, and shown at the Cannes Film Festival.

Iraq Veterans Against the War hosted the 2008 reprise of the 1971 hearings. Aaron Glantz, writing in One World, recalled testimony from former Marine Cpl. Jason Washburn, who said, "his commanders encouraged lawless behavior. ‘We were encouraged to bring ‘drop weapons,’ or shovels. In case we accidentally shot a civilian, we could drop the weapon on the body and pretend they were an insurgent.’<0x2009>"

An investigation by Chris Hedges and Laila Al-Arian in The Nation that included interviews with 50 Iraq war veterans also revealed an overwhelming lack of training and resources, and a general disregard for the traditional rules of war.

Though most major news outlets sent staff to cover New York’s Fashion Week, few made it to Silver Spring, Md. for the Winter Soldier hearings. Fortunately, KPFA and Pacifica Radio broadcast the testimonies live and, in an update to the story, said they were "deluged with phone calls, e-mails, and blog posts from service members, veterans, and military families thanking us for breaking a cultural norm of silence about the reality of war." 10. APA HELPS CIA TORTURE


Psychologists have been assisting the CIA and US military with interrogation and torture of Guantánamo detainees — which the American Psychological Association has said is fine, despite objections from many of its 148,000 members.

A 10-member APA task force convened on the divisive issue in July 2005 and found that assistance from psychologists was making the interrogations safe and the group deferred to US standards on torture over international human-rights organizations’ definitions.

The task force was criticized by APA members for deliberating in secret, and later it was revealed that six of the 10 participants had ties to the armed services. Not only that, but as Katherine Eban reported in Vanity Fair, "Psychologists, working in secrecy, had actually designed the tactics and trained interrogators in them while on contract to the CIA."

In particular, psychologists James Mitchell and Bruce Jessen, neither of whom are APA members, honed a classified military training program known as SERE [Survival, Evasion, Resistance, Escape] that teaches soldiers how to tough out torture if captured by enemies. "Mitchell and Jessen reverse-engineered the tactics inflicted on SERE trainees for use on detainees in the global war on terror," Eban wrote.

And, as Mark Benjamin noted in a Salon article, employing SERE training — which is designed to replicate torture tactics that don’t abide by Geneva Convention standards — refutes past administration assertions that current CIA torture techniques are safe and legal. "Soldiers undergoing SERE training are subject to forced nudity, stress positions, lengthy isolation, sleep deprivation, sexual humiliation, exhaustion from exercise, and the use of water to create a sensation of suffocation," Benjamin wrote.

Eban’s story outlined how SERE tactics were spun as "science" despite a lack of data and the critique that building rapport works better than blows to the head. Specifically, he said, it’s been misreported that CIA torture techniques got Al Qaeda operative Abu Zubaydah to talk, when it was actually FBI rapport-building. In spite of this, SERE techniques became standards in interrogation manuals that eventually made their way to US officers guarding Abu Ghraib.

Ongoing uproar within the APA resulted in a petition to make an official policy limiting psychologists’ involvement in interrogations. On Sept. 17, a majority of 15,000 voting members approved a resolution stating that psychologists may not work in settings where "persons are held outside of, or in violation of, either International Law (e.g., the UN Convention Against Torture and the Geneva Conventions) or the US Constitution (where appropriate), unless they are working directly for the persons being detained or for an independent third party working to protect human rights."

NEW YORK – It doesn’t take a genius to figure out that the United States’ financial system – indeed, global finance – is in a mess. And now, with the US House of Representatives having rejected the Bush administration’s proposed $700 billion bailout plan, it is also obvious that there is no consensus on how to fix it.

The problems in the US economy and financial system have been apparent for years. But that didn’t prevent America’s leaders from turning to the same people who helped create the mess, who didn’t see the problems until they brought us to the brink of another Great Depression, and who have been veering from one bail-out to another, to rescue us.

Filmed during their 2004 US tour, Laibach’s Divided States of America DVD (Mute) gives a good idea of the freak show that comes out of the woodwork to see the group’s rare performances.

The DVD focuses on the tense political climate and general ugliness of America during the weeks following George W. Bush’s reelection, and there’s enough sardonic anti-American sentiment in it to satisfy anyone who contemplated moving to Canada on Nov. 3, 2004. Much of the documentary involves interviews with Laibach concertgoers: a motley assortment that includes a self-proclaimed Church of Satan representative, a man who identifies himself as a fascist (Laibach’s "political orientation," he confesses, "is perhaps different than mine"), and an ordinary-looking father with his two young daughters in tow.

"The beat was totally infectious," recounts another interviewee. "My body couldn’t help but move."

Few bands inspire as many different reactions as the Slovenian collective, who are touring the States for the first time since 2004 and have been around since 1980, when Slovenia was, of course, still part of Yugoslavia. Are they fascist sympathizers? Is Laibach communist? Or is it all just a big joke? At one point during the DVD, an interviewer asks the outfit about the apparent Nazi-esque garb in one of their tour posters (a Laibach member replies that it’s actually American dress the person is wearing). Another journalist asks them why they promote Jesus and Christianity (one of their albums is titled Jesus Christ Superstars [Mute, 1996]). And as the fan quoted above proves, some people just like those "infectious" beats.

I imagine Laibach enjoy seeing the confusion they create, although there have been times when it’s caused legitimate problems for them — including a ban against playing in their hometown of Ljubljana in the early 1980s and several bomb threats at concerts during the ’90s.

Just what are Laibach trying to say, though? I don’t think there’s a clear-cut answer, but all you have to do is spend a little time with their back catalog to notice recurring themes: religion, fascism, war, patriotism and nationalism, and pop music itself. They’ve spent their career mocking these institutions and -isms, largely by turning them inward on themselves, exploiting and sullying them at the same time — after all, what could be more totalitarian than those nonstop techno beats? Yet they mock in such a straight-faced manner that many people seem to miss the wit. In the largely humorless landscape of industrial music, that sensibility is perhaps Laibach’s biggest saving grace.

Last year’s Volk (Mute) resurrects many of these themes. The disc consists of electro-symphonic renderings of various national anthems, topped off by Milan Fras’s inimitable spoken-word vocals. (Anyone who thinks it’s a celebration of cultural diversity or patriotism need only refer to the liner notes, where they quote a repugnant passage from a US foreign policy memo titled "In Praise of Cultural Imperialism.") They’ve taken on the Beatles and the Stones before (1988’s Let It Be and 1990’s Sympathy for the Devil, both on Mute), but the sly message here is that these national anthems are our ultimate pop songs. Or something like that.

As usual with Laibach, much of the interest lies in Fras’s ominous-sounding, often darkly funny vocals and lyrics. But the arrangements here are among the most stirring ones they’ve come up with since Opus Dei (Mute, 1987), although admittedly, some of their intervening work suffered from gaudy production and instantly dated electronic sounds. Best of all is "Rossiya (Russia)," with its children’s choir, wiggly synthesizers, and gently sweeping strings. They’ve called themselves wolves in sheep’s clothing, and their ability to cloak their sociopolitical commentaries in such convincing garb is part of the reason they’re so provocative and so hard to figure out. I give up.

REVIEW American Conservatory Theater’s season opener marks the 40-year anniversary of 1968 with the well-timed if less than well-executed Bay Area premiere of Tom Stoppard’s Rock ‘n’ Roll, which from the dual vantage points of Prague and Cambridge traces revolutionary politics and counterculture between 1968’s Prague Spring and 1989’s Velvet Revolution.

Stoppard’s latest but not greatest is almost a 20th-century coda to his grand three-part saga of 19th-century revolutionaries, The Coast of Utopia, building on the famed playwright’s ongoing interest in politics, media, culture, private vs. public life, and the motor of social change. But it’s also, by his account, a more personal play he’d long been considering, based partly on his own history as a Czech World War II refugee who settled happily into English life at a tender age.

Rock ‘n’ Roll‘s protagonist — and Stoppard’s stand-in — is Jan (a genial Manoel Felciano), a visiting exchange student at Cambridge. Within the familial embrace of hardheaded, hard-line Communist don Max (Jack Willis) and his wife, cancer-racked classics scholar Eleanor (René Augesen), Jan revels wholeheartedly in English life and ’60s counterculture — particularly its music. For Jan — whose LP collection is like a precious extension of his own person — tracks from the Velvet Underground, Pink Floyd, and the Doors are the stuff of revelation and ecstatic community. But unlike the playwright — and despite his antipathy to stifling Soviet bloc authoritarianism — Jan returns home to Prague in 1968 after Soviet tanks roll in.

The rest of the play cuts back and forth as life goes on, with Max twice fatefully visiting an increasingly cornered Jan in the interim. In Cambridge, the seeds of the ’60s blossom in ways bleak and hopeful, shadowed by the gentle but tragic presence (offstage) of original Pink Floyd frontperson and madcap Cambridge denizen Syd Barrett, here a Pan-like figure inspiring the protective devotion of Max and Eleanor’s flower child daughter, Esmé (Summer Serafin and René Augesen), and later Esmé’s own radical teenage offspring, Alice (Serafin). In Prague, meanwhile, Jan and friends negotiate two distinct realms of opposition: the embattled dissident movement headed by Václav Havel and others, and a countercultural rock underground of disaffected youth that, despite its so-called apolitical stance, is inherently political and threatening to a totalitarian regime bent on monopolizing the social sphere.

Despite a critical edge — brought out, for example, in Max’s admirable rant against the compromises of a supposedly free press — Jan’s and the play’s embrace of Western liberalism casts a vague "end of ideology" tone, as if Margaret Thatcher’s declaration that "there is no alternative" was correct, however crude and ruthless the messenger. But the real problem with the play is its lack of sustained tension. Helmed by artistic director Carey Perloff, the production pursues an impressive visual dimension but often falls dramatically flat. Rare exceptions include a scene in Cambridge in which Max’s crude materialism — and cruder clinging to his CP card and shopworn shibboleths — runs up against the most personal of rebukes: his beloved wife’s diseased, disintegrating body, which she movingly denies can encompass her identity and humanity. Company member Augesen does fine work here, as well as in the role of grown-up daughter Esmé. By contrast, the normally brilliant Willis feels miscast as Max. He’s just not a very convincing Englishman, and the attempt is both disappointing and distracting. Sturdy work from regulars Anthony Fusco, Jud Williford, and Delia MacDougall can’t fully alleviate the overall lethargy.

A damp firecracker of a ’68 tribute, in other words, but the real show is turning out to be in the streets anyway, as the increasingly tumultuous anniversary year rocks and rolls ominously along.

REVIEW What’s wrong with anger? Nothing — it’s a perfectly cromulent human emotion. But it sure makes for awful poetry, especially if it’s poured undiluted by humor, hope, or reflection into the "frail vessel" of verse, like hydrochloric acid into Tupperware. The poem may be true, the poem may be honest — but honey, the fumes’ll kill ya. I’ll happily read another righteous anti-Dubya rant, but it better at least make me laugh, dammit.

Which is why I approach a contemporary book like State of the Union: 50 Political Poems (Wave Books) with antsy trepidation. Current events are poetry’s bait and bane — who will write the great 9/11 poem, the great Iraq Occupation poem, the great Bush empire poem? Who cares but the poet who wants to be "great"? Life’s too short for speculative canonical teleology, let alone its correct pronunciation. And then there’s the anger thing. Poems are intrinsically liberal (anybody got a good anti-abortion aubade or Turd Blossom terza rima?). And if there’s one thing we’ve learned in the past few years, it’s that liberals can certainly sputter with outrage. Besides, what poem isn’t political, anyway? Even a Hallmark card’s sappy innards are mawkish missiles aimed for Granny’s good graces.

So hurray for the folks at Wave Books, whose broadminded selections in State, chosen after an open call for submissions, satisfy the need for like-minded connection but don’t stint on the wry entertainment, subtle engagement, or lyrical expression. Included are some comforting big names (John Ashbery, James Tate, Michael Palmer) as well as many lesser-known but perhaps more appropriate ones. I was tickled to read new shit from Matthew Rohrer, whose electric-fork-filled debut, 1991’s A Hummock in the Malookas (W.W. Norton), still weakens my knees, and Guardian contributor Garrett Caples, whose lethally crisp contribution here, For Thom Gunn, links the great local poet’s sad, meth-addled demise to our political system’s own: "Nightmare of beasthood, snorting, how to wake." No slouching toward either Bethlehem or Gomorrah there. Also great is Tao Lin’s stickily perverse "room night," which intrudes on fragments of airy philosophical rumination with obsessive cravings for 80-cent sesame bagels smeared with peanut butter and "beautiful music created by depressed vegans."

Yes, the greatest political hits of the past eight years are here, Guantánamo and all. Lucille Clifton’s quite-famous "september song: a poem in 7 days" is the ultimate "what were you doing when the towers fell" diary, transported somehow into political heresy by her insistent invocations of "apples and honey / apples and honey." Rohrer’s "Elementary Science for Dick Cheney" and Anselm Berrigan’s "The Autobiography of Donald Rumsfeld" uproariously take those curs on directly, while Dan Bogan’s "A Citizen" is a vertiginous inventory of the twilit ironies common to "great" empires. ("There were the usual cabals / careers to be made among court intrigues / as the wheels of dynasty ground slowly through a calendar of ceremonies.")

And my favorite entry in the volume is, indeed, a rant — "Dear Mister President There Was Egg Shell under Your Desk Last Night in My Dream!" by CAConrad — one of those rambling, touching run-ons that never stops for punctuation and shouts, "HEY we’re all going to be dead in a hundred years so let’s shift the pace let’s forget about war let’s pass a Let’s Get Naked and Crazy Holiday" and then proceeds to offer the president "a good massage maybe we could go to the creek and paint secret mud symbols on our naked bodies like I used to do with my first boyfriend what happens after that will be fine you’ll see." (1) War demands chronicling as few human endeavors do, with representations spanning from cave drawings to cell phone photographs. German experimental filmmaker Hito Steyerl considers the volatility particular to the filmic war document in her elegant short November (2004), playing in Kino21’s series "How We Fight: Conscripts, Mercenaries, Terrorists, and Peacekeepers" (kicking off Sept. 25 and continuing through October, with the last program screening Nov. 23). Steyerl’s essay-film turns on her reexamination of some spunky "feminist martial arts" footage she shot of her friend Andrea Wolf in light of the woman’s later martyrdom as a Kurdish freedom fighter. Competing renditions of Wolf commingle, each containing elements of documentary and fiction, with the only real truth being Wolf’s sublimation as a "traveling image."

(2) The YouTube hell of the footage captured in Iraq and Afghanistan — as dramatized in Brian de Palma’s angry Redacted (2007) and the damaged fictions of Michael Haneke — was perhaps foreseen by Walter Benjamin in 1936: "The destructiveness of war furnishes proof that society has not been mature enough to incorporate technology as its organ." So it is that the crudeness of the digital loops shot by coalition forces and insurgents alike countervails the US military’s computerized advancements. "How We Fight" opens with a compilation of this undigested material: footage from both sides synthesizing an implacable wave of mutilation. Insofar as any war can be said to have a film aesthetic, Iraq’s is that of the surveillance shot — the natural complement of the conflict’s signature weapon, the IED. As if we were watching some perverted version of the Bazinian long take, we observe, in a real time blighted by dirty pixelation and distorting zooms, as a convoy approaches an explosion.

(3) In an expanding field of unprocessed moving images, the documentary increasingly sees its own role shift to that of an interpreter of visual information already at hand. How else to explain all the recent documentaries dedicated to contextualizing id-like streams of footage from the battlefield and newsroom? It remains to be seen which of these works will deliver as lasting an indictment as Winter Soldier (1971), a collectively directed project that counterposes soldiers’ colored 8mm footage from Vietnam with the mauve black-and-white of their testimonies. For "How We Fight," Kino21 screens the rarely seen Interviews with My Lai Veterans (1970), a short film that cuts to the same bone.

(4) The issue of how these films garner testimony is of paramount importance, as evidenced by Errol Morris’ problematic probe of Abu Ghraib’s "bad apples" in Standard Operating Procedure. Exemplary in this regard is Heddy Honigmann’s Crazy (1999). The Dutch filmmaker is a master interviewer who treats her subjects as autonomous beings — Honigmann isn’t afraid to prod, but she’s not after dramatic effect. In Crazy, she stitches together interviews with Dutch veterans of United Nations peacekeeping missions by asking them to share songs they associate with their deployments. The music, which ranges from Cambodian pop to Guns N’ Roses’ take on "Knockin’ on Heaven’s Door," opens the channels of memory in unexpected ways and midwifes the guarded soldiers toward reflection and emotion. The passages in which Honigmann holds close-ups of the veterans listening to their songs possess a plaintive mystery unavailable to Morris’s occupied camera.

(5) In the singular, combat films of all kinds often extol the false premises and ideals endemic to war. But taken as a collective enterprise, war documentaries pull back the curtain on the state-sponsored stagecraft and reveal the threads connecting disparate battles. We’re ever reminded that "only the dead have seen the end of war." But if we take Hito Steyerl’s spin through one particular labyrinth of war-scarred images at face value, even they may not be safe.

Road trip: Iraq

REVIEW Given the subject matter — soldiers returning home from Iraq — it should come as no surprise that the title The Lucky Ones is more than a little ironic. But things here aren’t quite so cut-and-dry. Despite its focus, the film maintains a stubborn refusal to get too bogged down in the melancholy or the politics; it’s a serious drama that’s often very funny and mostly lighthearted. At the movie’s center are three soldiers — Cheever (Tim Robbins), Colee (Rachel McAdams), and TK (Michael Peña). Accidentally thrust together, they embark on an unscheduled road trip, each with a separate mission. Cheever is trying to put his life back together; Colee wants to meet the parents of her late boyfriend; and TK hopes to restore function to his penis, which was wounded by shrapnel. Seriously. Though not the most conventional Iraq war story, the road movie formula is routine and elements of the plot feel somewhat stale. What elevates The Lucky Ones is a trio of memorable performances. Rachel McAdams is particularly impressive as Colee, delivering a complex portrayal of a woman ranting about the "lake of fire" one minute and raving about vibrators the next. She reflects the film’s strongest assets: finding the humor in tragedy and sighting the mundane in the unreal.

“Istanbul-Berkeley”

REVIEW When veteran Istanbulite Orhan Pamuk received the Nobel Prize in literature two years ago, the committee complimented his "quest for the melancholic soul of his native city." Melancholic? The world’s third largest city has one big, melancholic soul? I think Pamuk, of all people, would disagree. The 10th International Istanbul Biennial, which was curated by über-busy San Francisco Art Institute faculty member Hou Hanru in 2007, took a more caustic if not realistic theme: "Not Only Possible, But Also Necessary: Optimism in the Age of Global War." The organizers of the "Orienting Istanbul" conference at Berkeley this week have produced a truly interdisciplinary (and free to the public) conference that cuts through the jargon and confronts big ideas head-on. Nonetheless, I’m glad they snuck in some actual art, including "Istanbul-Berkeley," Hanru’s selection of video works from the biennial.

Much of Hanru’s curatorial work has focused on urbanization and living, breathing cities. The chosen videos do not disappoint. They address spatiality in radically different ways. Sulukule, the oldest Roma neighborhood in Turkey, has recently been subject to changes alternately referred to as "urban renewal" and "forced gentrification." Wong Hoy-Cheong involved his subjects — Roma children — in the production of Darling Sulukule, Please Sulukule (2007), creating a hyperrealism caught between a flashback to childhood and a dream of the future. Emre Hüner’s textural Panopticon (2007) has a healthy tinge of mysticism, making it a good balance to the disorienting Boumont (2006), also by Hüner. Taking interpretation of urban life beyond Istanbul, Cities of Production (2006), by MAP Office (www.map-office.com), the thrilling collaboration between architect-artists Laurent Gutierrez and Valérie Portefaix, brings a startling sense of playfulness to factory life in Hong Kong and the Pearl River Delta.

The red and the black: Shepard Fairey at Shooting Gallery, White Walls

I had no idea when I pitched a piece on Shepard Fairey’s “Duality of Humanity” solo show that I’d be getting an up-close preview, a public/private wheat-pasted hanging on the western wall of my room, now amounting to the best street “graffiti” (it was sanctioned by my landlord)/anti-war advert in the ‘hood.

A totally auspicious coincidence, or have I just somehow managed to know enough cool people that the degrees of separation are getting fewer by the day? I’m not sure, but hosting a giant black and beige “Peace Bomber” – yes, a peace sign made of a bomber plane – is pretty sweet.

This does not substitute for paying a long visit to Fairey’s four-room, two-story show at the Tenderloin’s adjacent art hubs, the Shooting Gallery and White Walls. Nor should the sudden ubiquity of public art Fairey and his nighttime posse have offered the city these past couple weeks – from the watchful, familiar furrow of Andre the Giant stickers to his larger visage where Highways 280 and 101 intersect to the red, blue, and black Obama poster (the one piece not for sale in his show) on the side of that squatable-looking house at 15th and Dolores streets.

A message from Angels?

If I were Christopher Ablett — who police say shot Frisco Hells Angels head Mark “Papa” Guardado on Sept. 2 in the Mission District — I would seriously consider turning myself in to the police. If the 1500-2000 grieving bikers with their mile long chrome and leather procession didn’t send a clear enough message then surely the three pipe bombs detonated early this morning at the San Jose home of Mongols leader Robert Rios must have gotten their point across.
There is no proof that the Hells Angels were responsible for the attack, but if I were Ablett I would feel a lot safer in custody than facing retribution from the “filthy few,” the club’s fabled death-squad. No one was hurt when the bombs went off around 4 a.m. this morning, but authorities have begun to express fear that the attack may herald an “all out war” between the rival clubs.

Class revolting

Americans are allowed to talk about class on the condition that we say we are all middle class — never mind if your ‘rents pay for an out-of-state, private college without financial aid, or if you’re a single mom struggling to pay Bay Area rents on service industry wages. Regardless of our assets, we’re all the same if we pull ourselves up by our bootstraps, right? So despite capitalism’s emphasis on abstract equivalence, class is at least one area where the bourgies insist on qualities over quantities: "You can have my Horatio Alger narrative when you pry it from my cold, dead hands!"

Thus, comparing Harvard-educated pop duo Chester French to Vampire Weekend because their members seem to have leapt from the same L.L. Bean catalog misses what is genuinely questionable about their act. While neither band ever talks about what their parents do for a living, they both make playing with old-money signifiers a big part of their repertoire. But while Vampire Weekend’s self-described "Upper West Side Soweto" juxtaposes citations of third world pop with symbols of upper-class belonging, that superficial move is at least designed to give the listener pause. The unsubtle doofuses of Chester French mangle their subject matter, driving every obvious detail into the ground. The Zombies-biting power pop of "She Loves Everybody," for example, opens with a shuddering, prim string trio before ditching the classical instruments for well-tempered synths, clean-cut tremolo guitars, and a by-the-books jaded-romance narrative so obvious it’s vaguely insulting to the listener’s intelligence.

Even worse, these bros’ steez stumbles over itself to incorporate high-end, contemporary pop culture, from which VW’s music tends to hold itself aloof. Not that being slightly out of date is inherently superior to being current, but the latter group is at least smart enough to drop its Lil Jon reference four years after "Yeah!" Chester French’s best song — which is still terrible — is the pinched, flimsy "The Jimmy Choo’s" [sic], whose fratboy-with-a-Bret-Easton-Ellis-fetish lyrics clumsily and successfully attempt to pander to the Sex and the City (or is it Gossip Girl?) demographic. Don’t be fooled, though: it’s not class evocation — though they’re pretty bad at making that angle interesting — that makes them especially tiresome. It’s that the Chester French marketing bundle is so clearly designed to float bankrupt songwriting on a pseudo-provocative presentation.

Their ruthlessly calculated niche-marketing conjures up secret pact scenarios with the Wesleyan-affiliated, improbably popular MGMT — "OK, so you guys go for the humanities majors, and we’ll get the sociology/business dudes." The bad news is that it worked: these guys came out of a bidding war with a Star Trak deal and MGMT scored a Columbia contract. Maybe we should make a pact of our own: let’s not talk about class using the terms they’re feeding to us. Who cares about the Ralph Lauren sweater? We want to know what your parents do for a living.

New blood

What possesses Towelhead director and Six Feet Under creator Alan Ball to explore those gray areas where sexuality converges with morality? "It’s fascinating," Ball says, sequestered in San Francisco’s Ritz-Carlton for a series of interviews. "I feel like I’m at a point where really well-adjusted people are the kind of people I like to have in my life. But as characters in fiction — shoot me! I would be so bored."

Ball unleashes a magnificently chortle, more Henry VIII than writerly introvert: "I’m interested in the mistakes people make [and] in the dilemmas where people’s true characters are called into question. I’m interested in those mythic moments in everybody’s life."

Towelhead, which Ball adapted from Alicia Erian’s 2005 novel, is unflinching in its depiction of the culture shock and flowering sexuality of 13-year-old Jasira (Summer Bishil), an Arab American girl relocated to Houston to live with her strict Lebanese father (Peter Macdissi). The film is also courageously unjudgmental concerning the choices the young girl makes — which include her relationship with Army reservist Mr. Vuoso (Aaron Eckhart), who lives next door. Ball sets the disarmingly realistic mood of Towelhead perfectly with his opening scene of Jasira about be given a "mercy" shave by her mother’s boyfriend, though few would suspect that he would so adeptly grapple with the narrative’s complex perspective on race — not to mention the parallels one might draw between the film’s mis-en-scene, set during the Gulf War, and today’s conflict in Iraq.

In contrast, Ball’s latest TV foray, True Blood, which recently premiered on HBO, casts its nets far from reality into a pulpy, supernatural future where vampires can openly live among humans following the invention of synthetic blood. Can a telepathic young woman find true blood — or rather, love — with a guy who sucks? It sounds like Ball is happy to stem the angst flowing through so many of his projects. "I thought, enough with the existential naval-gazing," he says, laughing. "Been there done that."

The Mission District has been swarming with police officers lately. They were present and visible in large numbers in recent weeks in an effort to stem a recent tide of mostly drug- and gang-related killings in the heavily immigrant neighborhood.

"When 14, 15, and 13-year olds are running around with guns, we have a serious problem," San Francisco Police Chief Heather Fong said at a recent press conference as she urged the community to call 911, or the police department’s anonymous hotline, to report suspected shooters.

"All these people come from families, and these family members may hear or know something, or see a change in behavior," Fong said.

But community advocates warn that Fong’s boss has made it less likely that immigrants will talk to the police. Since Mayor Gavin Newsom’s recent decision to notify immigration authorities the moment the city books undocumented juveniles accused of committing felonies, fear that the Sanctuary City laws are eroding may be driving the very sources Fong needs deeper into the shadows.

Shannan Wilber, executive director of Legal Services for Children, told us that the new policy is already having an impact.

"It’s a warning sign that no one is safe, that people can’t go to Juvenile Hall and pick up their kids, because they’ll be swept up by ICE, too," Wilber told us. "People are saying, We don’t feel safe reporting a crime we witnessed or were a victim of.’<0x2009>"

Mission Captain Stephen Tacchini told the Guardian last week that he’s not hearing that the community is clamping up because of the mayor’s newfound willingness to send juveniles to the feds for possible deportation. But he acknowledged that he doesn’t know the immigration status of folks who talk to the police at meetings and on the street.

"How many undocumented aliens come forward and assist us?" he asked. "Well, it’s possible they use the anonymous tip line."

PROTECTING PUBLIC SAFETY?


In an Aug. 8 San Francisco Chronicle op-ed, Newsom wrote, "the underlying purpose of the sanctuary-city policy is to protect public safety."

First signed into law in 1985, the city’s sanctuary ordinance designated San Francisco a safe haven for immigrants seeking asylum from war-torn El Salvador and Guatemala. The city extended the policy to all immigrants in 1989, saying it would not use resources or funds to assist federal immigration law enforcement, except when required by federal law.

Over the years, the city’s sanctuary legislation was amended to allow law enforcement to report felony arrests of suspected undocumented immigrants. City officials, however, came to believe that state juvenile law prevented them from referring undocumented juveniles to the federal authorities.

The city’s decision not to notify Immigration and Customs Enforcement about undocumented juvenile felons came under the media spotlight this summer when someone leaked to the Chronicle that the city had used tax dollars to fly undocumented Honduran crack dealers home. Some convicts were sent to group homes in San Bernardino County, and the city was left empty-handed and red-faced when a dozen ran away.

When the Chronicle articles hit, Newsom, who had just filed to explore a run for governor, claimed that the city could do nothing — the courts had jurisdiction over undocumented juvenile felons.

But the next day, Newsom did an abrupt about-turn.

"San Francisco will shift course and start turning over juvenile illegal immigrants," Newsom said. "We are moving in a different direction."

But the public was left in the dark about how far this new direction would veer until Sept. 10, when Siffermann unveiled details at a Juvenile Probation Commission meeting.

Community-based organizations and immigration rights attorneys complained that the policy ignored all but one of the recommendations they made in July and August to Siffermann, city administrator Ed Lee, and Kevin Ryan, a fired former US Attorney whom Newsom tapped to head the Mayor’s Office of Criminal Justice in January.

Angela Chan of the Asian Law Caucus warned the commission that the policy, which has already resulted in 50 juveniles being referred to ICE, may result in the deportation of young people who had not committed any crime, or whose felony charges were dropped.

Community organizer Bobbi Lopez asked commissioners, "Why do we have a political will to demonize these kids who have been trafficked into this country?"

And Francisco Ugarte, a lawyer with the San Francisco Immigrant Legal and Education Network, said the policy is akin to "rounding up all of Wall Street because there are bankers involved in insider trading."

The commission decided to form an ad hoc committee to review the policy, but the immigrant advocates and attorneys we contacted expressed little hope of change, given the impending presidential election and Newsom’s gubernatorial ambitions.

Some went so far as to suggest that the Joseph Russoniello, who opposed churches and synagogues offering sanctuary to Salvadorans and Guatemalans in the 1980s, and became the US Attorney based in San Francisco in January 2008, had drafted the mayor’s new policy.

Patti Lee of the Public Defender’s Office noted that the Mayor’s Office did not discuss the policy changes with her office, the courts, the prosecutors, or the people involved in immigration litigation.

Claiming that 99 percent of kids arrested in the city are not violent felons, Lee said, "They are mostly engaged in drug sales to survive and to send money back to their families."

Probation chief Siffermann defended the new policy direction. "Just because ICE is notified about suspected undocumented juvenile felons doesn’t mean they will be deported," Siffermann told us. "I know there’s a fear that this will open an automatic trap door to horrendous facilities and poor conditions, but this is not about dropping kids off in the middle of nowhere. What we are talking about includes outreach for families with adolescent members on the road to a delinquent involvement, whose actions call attention to the entire family situation."

Reached by phone, Russoniello told us, "If the city had scrupulously followed the ordinance as it’s written, there would not have been this controversy."

POLITICAL AGENDA?


Russoniello claimed that ICE’s first concern is people engaged in criminal activity, and agreed that in some cases, petitions may not be sustained against juveniles referred to ICE.

"But ICE may determine that the person is a member of a gang or engaged in regular criminal behavior," Russiniello added.

Russoniello also told us that the city is probably looking at its past files on undocumented juvenile felons to determine its own liability.

"Certainly, if people who are now adults were committing heinous crimes as juveniles, people are going to be wondering why they weren’t deported," Russoniello said, alluding to a June 22 triple homicide in which three members of the Bologna family were shot while returning home from a picnic.

Allegations emerged in July that the prime suspect in that killing, Edwin Ramos, 21, was an undocumented MS-13 gang member who committed felonies and went through the city’s juvenile system, but was never referred to ICE. That further embarrassed Newsom.

Kris Kobach, a one-time counsel to former US Attorney General John Ashcroft and the current Kansas Republican Party chair, is representing several surviving members of the Bologna family, who filed suit against the city claiming its sanctuary policies were a "substantial factor" in the slaying and blaming the Juvenile Probation Department for adopting "official and unofficial policies."

Russoniello claims that a review of monthly records that JPD has kept since 2004 show an uptick in alleged juvenile Honduran felons, and that this should have been a tip-off. "Are people gaming the system, or are organized groups taking advantage of the city’s leniency?" Russoniello asked.

Noting that 30 percent of these so-called teens were in fact adults and that significant numbers of gang members are "illegal aliens," Russoniello claims that the spur to shift policy was the city’s attempt to transport people back to Honduras in December 2007, which was brought to his attention in January, when he took office.

"We attempted to remedy it quietly, without much success," Russoniello recalls. "The city decided to send people to group homes. If you want to find a political agenda, look to the Mayor’s Office."

Calls to Ryan remained unanswered as of press time, but mayoral spokesperson Nathan Ballard e-mailed us that Newsom ordered a new policy direction May 22 "because he felt the old policy violated the intent of a sanctuary city, which is to promote cooperation by undocumented residents with law enforcement, not to harbor criminals."

The city attorney issued an opinion authorizing notification on July 1, Ballard wrote. Notification began July 3, and written protocols were publicly presented Sept. 10.

As for Russoniello’s comment about political agendas, Ballard retorted, "This isn’t about politics, it’s about public safety. In order to preserve the sanctuary city policy, we need to ensure that it complies with state and federal law so that it is not vulnerable to attack."

A house divided

Just as the US presidential election hits the home stretch, internal strife at one of the country’s largest labor unions appears to be diverting its focus from electing Barack Obama.

The Service Employees International Union (SEIU) and its 2 million members helped Obama defeat Hillary Clinton in the Democratic primary. Its ground operation and bulging political war chest are crucial to Democratic Party hopes in November, both in the presidential election and congressional races. But a recent corruption scandal and an ongoing internal dispute that threatens to blow up in the coming weeks could undermine the union’s political influence at the worst possible time.

"If SEIU didn’t have to deal with this distraction, it would be able to do more to influence the election," Dan Clawson, a labor scholar and professor of sociology at the University of Massachusetts, Amherst, told the Guardian. "California [where nearly all of SEIU’s recent turmoil has taken place] is not where they should be."

But according to several sources within SEIU, the union will be devoting resources to the Golden State this fall, even though the state is widely expected to remain a Democratic stronghold. The sources contend that the organization is preparing to deploy hundreds of its staffers to the region to take control of a local union affiliate and to deal with any potential fallout. At least some of those staffers, the sources say, would have been devoting their time and energy to the election campaign if not for SEIU’s internal troubles.

Last month the union’s international office was forced to "trustee," or take over, its largest California affiliate after the Los Angeles Times ran a series of articles exposing alleged corruption by its leader, Tyrone Freeman. Then, in late August, SEIU announced it was initiating a process to assume control of its second-largest California local, the Oakland-based United Healthcare Workers–West (UHW). For months, SEIU president Andy Stern has feuded with UHW head Sal Rosselli over Stern’s push to consolidate local union chapters into larger and more centralized units [see "A less perfect union," 4/9/08, and "The SEIU strikes back," 4/16/08].

Stern and the international have charged Rosselli and other UHW officials with misappropriating millions of dollars. In late July, a federal judge dismissed a lawsuit brought by SEIU covering these same charges. Now SEIU has scheduled its own hearings on the matter to decide whether to clean out UHW’s leadership. The hearings are set for Sept. 26-27 at the San Mateo County Event Center. A separate lawsuit challenging UHW leadership brought by individual UHW members is also moving forward. Rosselli and his supporters strongly deny the allegations of financial misconduct. They claim the upcoming trusteeship hearings are simply Stern’s latest attempt to stifle dissent within the union.

"It’s a kangaroo court," Rosselli told us. "It’s a purely political move to silence our members. And it’s a huge distraction."

SEIU’s turmoil is not welcome news to progressives. Federal election records show that the union’s political arm has dropped more than $10 million into Obama’s candidacy, as well as millions more for other left-wing candidates and causes. Beyond monetary support, Democrats are counting on SEIU organizers to hit the ground across the country, especially in hotly contested states like Pennsylvania, Florida, Ohio, Colorado, and Missouri. But because of the feud, a good number of those foot soldiers could be spending this autumn in safely blue California instead.

If the hearing officer hired by SEIU allows the union to take over UHW, another labor scholar, who spoke to the Guardian on condition of anonymity, said, "It’s hard to see how [SEIU] would do it without bringing in a significant number of people." He explained that in the event of a trusteeship, some or all of the staff may need to be replaced. The union also might have to contend with a large number of extremely disgruntled people in its 150,000-member affiliate.

Officials at UHW told us that members are planning "massive" demonstrations at the two-day hearings in late September. And the upheaval could easily drag on through the rest of the campaign season if the trusteeship moves forward. Rosselli predicts there will be "major resistance" from his rank and file. He would not elaborate on what that resistance would consist of, but a resolution passed at a recent UHW leadership conference struck a decidedly militant tone: "UHW will fight to keep our members united in one statewide healthcare workers union and will use all available means."

Rosselli told us that resisting SEIU’s trusteeship would "dramatically" curtail his local’s political activities. During the primary season, he added, UHW dispatched teams of organizers to Iowa, New Hampshire, and other critical states. But for the general election, they will be staying home. "We’re in a civil war," Rosselli said. "We need everyone here to defend against Stern’s dictatorship."

The Guardian has learned that Obama and other progressive candidates may not just be losing valuable campaigners from UHW. Several UHW sources said they expect SEIU to send large numbers of union organizers to the Bay Area in the wake of the hearings — and two management-level sources from the international’s staff confirmed those suspicions to us.

The first source, who asked not to be identified, told the Guardian that numerous colleagues at the organization have been approached by "senior international staff, attempting to recruit them and other organizers to come to California … to implement the [possible] trusteeship." The source added that people within the organization believe the union is planning to send "hundreds" of people.

A second management-level source at the international, who also requested anonymity, told us that they have personally assigned several organizers to campaign work only to see those staffers reassigned to the UHW matter by international higher-ups. The second source reiterated the first source’s contention that the union is looking to send "hundreds" of what the source termed "troops" to Northern California to replace any UHW staff who quit or are expelled, and to quell any uprising by disgruntled UHW members.

"This has been deemed an imperative at the top levels of the union," the second source continued. "People have been told [the] numbers of people they need to assign [to the UHW feud] and been told to look over their staff lists to see who they can assign."

Michelle Ringuette, a spokesperson for the international in Washington DC, told us that "no one is being pulled off of political work" to deal with the UHW situation. While she wouldn’t deny that some organizers who might otherwise be involved in lower-level political activities "like get out the vote operations" might be sent to California if needed, she denied that staffers who specialize in politics would be diverted or that hundreds of staffers would be involved. Get out the vote efforts such as phone banks and door-knocking are often performed by union workers on behalf of Democratic candidates — and they can be decisive in a close election.

"Of course this [the trusteeship hearing] is unfortunate timing," Ringuette said. "But … we don’t believe this is going to affect out advocacy for Barack Obama. That is our top national priority."

But a third employee of the international we spoke with rejected Ringuette’s description of a division of labor within the union’s organizers. The longtime employee, who also asked not to be identified for fear of retribution, told the Guardian that a small number of international staffers may specialize exclusively in political activism, but virtually all organizers would be working on the fall campaign in a normal election year.

"If they’re sending organizers to California [to deal with UHW], they’re definitely moving them away from battleground states. California is not considered a battleground state."

Our other two sources at the international echoed the third source’s characterizations.

In a strongly worded letter to Stern dated Sept. 9, UHW’s secretary treasurer Joan Emslie stated that the trusteeship hearings "can only distract" SEIU from political activism and "hinder our ability to put the greatest possible efforts into this critical national election." The letter ended by requesting that the trusteeship hearings be postponed until "a date no earlier than Nov. 10," one week after the presidential election. As of press time, the international has not rescheduled the hearings.

Obama campaign officials we contacted declined to comment on what one called "an internal union matter." But some labor observers were willing to voice their displeasure with the timing of the dispute. Professor Nelson Lichtenstein, director of the Center for the Study of Work, Labor, and Democracy at UC Santa Barbara called the trusteeship hearings "a huge mistake." With the upcoming election, Lichtenstein went on, "the consequences could be enormous. What’s the rush?"

Welcome the new in – and usher the old out. George Clinton and Parliament Funkadelic will ring in 2009 on New Year’s Eve at the Warfield, and Les Claypool will tackle Zappa at the War Memorial Opera House, courtesy of Goldenvoice/AEG Live – this I learned while taking a quick tour of the revamped Warfield late last week with Dave Lefkowitz, VP of booking, and Joan Rosenberg, director of marketing.

Crews were still scrambling to complete renovations in time for this past weekend’s performances with George Lopez. But the top-o’-the-line, new sound system from Meyer Sound was in place, as was a lighting trellis that will allow touring bands to get creative and bring in their own setups. Nifty new switcheroos include the departure of the mixing board from the balcony, down to the first floor, and the addition of a bank of 30 new primo-viewing seats upstairs, and the savvy move of shifting two bars on the first floor in the main room – one away from an emergency exit. The inclusion of six speakers mid-house, downstairs, should definitely improve the sound for the attendees in the back and in the VIP boxes.

Photos of past shows from Wolfgang’s Vault and other sources lined the walls along with official and underground posters of past Warfield shows: Rosenberg said the walls will showcase a rotating display of the venue’s history. New carpets lined the floors throughout the space, and upstairs, the renovation crew uncovered two old telephone booths from the early part of the 20th century.

The tumultuous first 60 seconds of “Pokrovy Nebesnogo Startsa,” the second track off Arkona’s fourth studio full-length, Ot Serdca K Nebu, make me proud to be Russian. Is it the war-like chants, the growling Masha “Scream” or the traditional Slavic “Volynka” bagpipes? Maybe it’s the violently pitch-shifted guitars and rapid-fire drums, followed by the sweet cacophony of Eastern European folk instruments lilting through the fusillade?

Then I remember I’m totally not Russian and feel a tad weirdly nationalistic. But for ethnomusicologists with an open mind toward the heavy or headbangers into Viking metal like Tyr, Arkona’s epic tribute to Russian ecology and pre-Christian battle gods tempers the uber-patriotic ideology of the Slavic world’s most well-known “Rodnovery” (“native faith”) metal band.

As a child I remember being transfixed by the cover to Electric Light Orchestra’s 1974 album Eldorado, A Symphony (Warner Bros.). I think I saw it before I ever actually watched Victor Fleming’s 1939 film The Wizard of Oz, from which the album’s art is taken. Designer Sharon Arden — now Ozzy Osbourne’s wife — was undoubtedly riffing off of the concept album’s storyline about a journey through a fantastic land. But she also probably keyed into what caught my young eyes: the primary pop of red, yellow, and green, and the contrast between the girl’s glittering, covetable shoes, the ghoulish mint hands that reached toward them, and the shower of sparks that divided the frame.

Looking back now, my fascination with that image almost seems like a joke about gay predestination — even though my pre-teen self knew nothing of Judy Garland or the Cowardly Lion’s sissy shtick. But I know I haven’t been the first pre-queen or proto-wicked witch to be drawn to those heels. Since The Wonderful Wizard of Oz was first published in 1900, and transformed by MGM into the iconic musical four decades later, the peaceable kingdom created by Frank L. Baum has been visited, amended, annexed, redrawn, and reclaimed by readers young and old: friends of Dorothy; contemporary fantasists such as Gregory Maguire and Geoff Ryman; bric-a-brac collectors; librettists; and last but not least, Pink Floyd–loving stoners and artists.

It is that last group whose contributions to the Oz mythos comprise the Wattis Institute’s inaugural exhibition for the fall, "The Wizard of Oz." It’s not for lack of brains, heart, or courage on the part of curator Jens Heffman that the show is a mixed bag. Granted, exhibits organized around themes are often erratic affairs, but perhaps it is the Oz mythology’s chimerical ability to be all things to all people (witness the interpretive turns the novel and film version of Wizard of Oz have been subjected to, from populist allegory to pre–World War II national rallying cry, to ’70s fry toy) that makes some responses to it seem odd while allowing others to shine as revelations.

In three tightly-packed rooms, history abuts fantasy and artifacts mingle with reproductions. A fragment of Harry Smith’s kaleidoscopic, stop-motion animated remake of Fleming’s 1939 film flickers kitty-corner from Walker Evans’ portraits of ’30s sharecroppers — their ambivalent gazes providing a stoic historic counterpoint to the MGM film’s Kansas sequences. Mass-produced ’70s-era Scarecrow and Woodsman bookends hold up a rare turn-of-the-century set of all 13 Oz volumes. A playful Oz alphabet mural by Donald Urquhart serves as a primer on the series’ significance in postwar gay culture (Q is for Queer Icon; J is for Judy’s hand, supposedly severed before her funeral), while William Wallace Denslow’s doll-like renderings of Dorothy for the first edition of Baum’s book might surprise all those friends of Dorothy accustomed to Garland’s oddly mature visage.

Many contributions make overt references to the realm of Oz, yet oblique treatments of the broader themes evoked by the book and film — escape, the power of fantasy, and the uses of nostalgia — result in some of the exhibit’s strongest pieces. Evan Holloway’s kinetic sculpture Tin Man, in which an ax set in motion by a pulley mechanism takes a small chip off a log, generates discomfort. It does so through the disparity between its pathetic result and the violence of its noisy operation. Rivanne Neuenschwander’s 2003 Eu desejo o seu desejo cleverly plays on wish fulfillment, asking viewers to own up to their desires by taking a ribbon printed with a variety of wishes — some altruistic ("I wish for peace"), some selfish ("I wish for an easy death") — before leaving a handwritten wish in return.

One of my wishes was granted, if from a distance. The famous ruby slippers — or at least a pair that looks like them; the originals being housed in the Smithsonian — are indeed there, under glass like some reliquary. Scrawled inside the satin lining, in a slightly sloppy script, are the words "Judy Garland." Suddenly, I’m not in San Francisco anymore.

ST. PAUL, Minn. — The bright white light of flash bombs can be seen everywhere among the scattering crowd. Loud explosions of concussion grenades mix with the lighter, metallic tinkling of tear gas canisters bouncing along the pavement. Lines of police dressed in full riot gear stretch beyond the sulfur-green clouds of smoke bombs. Shouts come from all directions in the darkness, suddenly lit up like a war zone.

"What are you doing? We’re peaceful!" some people scream.

"Turn around! Go back!" police shout.

People are scattering now despite cries from some protesters to stay together. As they retreat, demonstrators bump into police lines blocking off escape routes. The police — on horses, motorcycles and bicycles, in squad cars, even driving dump trucks with lowered snowplow blades — attempt to herd the crowd.

"No more tear gas!" some people yell as they try to escape, their eyes red and watery as medics attempt to help amid the chaos. Others scream, "Where do you want us to go?" as officers plug them with mace.

Still others are getting angry. "Fuck you, pigs!" they shout in defiance, attempting to hold their ground, at times hurling projectiles at the police as the explosions continue.

Despite attempts by police to herd the crowd, people are running wild through the neighborhoods surrounding the Minnesota Capitol Building in St. Paul. They dart through parking lots and unblocked streets, trying to escape and hoping to regroup. Cars screech to a stop and bystanders are swept into the mass as they, too, attempt to sidestep the onslaught of police firing from all directions.

Beginning with nearly 1,000 people, this demonstration has been reduced to around 200. It started earlier as an antiwar rally on the Capitol lawn, the latest in a week of protests and civil disobedience, a citizen response to the Republican National Convention taking place at the Xcel Energy Center in St. Paul. It is Sept. 4, which means John McCain would soon be inside, offering his version of the next four years of America.

By the end of the convention, more than 800 people, including journalists, street medics and legal observers, will have been arrested in RNC-related protests, many having experienced a similar use of force by police.

There had been showdowns between zealous police and protesters all week.

On Aug. 29, police raided the headquarters of the RNC Welcoming Committee, an anarchist organization that says it was here to provide assistance to people who wanted to disrupt the convention through direct action and civil disobedience.

Police said the raid was the culmination of an undercover operation that began a year ago, in which officers claim to have heard discussions about plots to disrupt the convention. During that raid and subsequent raids of the homes of some local activists, police said they found caltrops for popping tires, buckets of urine to throw on police, and hand links for creating human barricades, among other items that could potentially be used to disrupt the convention.

The RNC Welcoming Committee refuted the police claims. "The raid was an effort to derail RNC protest organizing efforts and to intimidate and terrorize individuals and groups converging in the Twin Cities to exercise what are supposed to be their basic civil rights," said Tony Jones, a member of the group.

"We are not the terrorists," another spokesperson later said. "The terrorists are inside the Xcel Center."

Among some 10,000 protesters in St. Paul last week — far more than the contingent that protested at the Democratic National Convention the week before — was a strong contingent of self-proclaimed anarchists, whose direct-action style of protesting led to a near-continuous conflict with police. This became the focus of local and national media coverage, and while to some degree it represented the vibe on the streets, there were also thousands who came to engage in peaceful civil disobedience.

Despite last-minute revisions to the RNC schedule, thousands gathered on Sept. 1 for the March on the RNC protest — the largest of the week — to kick off the opening day of the convention. Throughout the day, confrontations broke out between police and autonomous groups of protesters attempting to block roads and bridges around the city. Some became violent, and there were mass arrests.

Tuesday night, the Poor People’s March For Our Lives" protest provoked confrontation, when several hundred people who marched to the free speech "cage" — a barricaded area outside the Xcel Energy Center reserved for protesting — refused to disband after police issued three dispersal orders. Like the previous day, police began firing tear gas into the crowd, eventually pushing the people to a park, where some 60 were arrested.

The Sept. 4 rally was permitted, but the march was not. The Twin Cities Anti-War Committee, which organized the event, made clear from the beginning it intended to march to the Xcel Energy Center to try to disrupt McCain’s acceptance speech.

At the rally, which preceded the march, a speaker commenting on the mass arrests of protesters asked the crowd, "Are the people responsible for the criminal war on Iraq and the war at home on the poor ever held accountable for their actions?"

"No!" came the reply.

Police had the rally surrounded and intermittently plucked people from the crowd, placing them under arrest for unknown reasons — the most common charges were unlawful assembly, felony property damage, and felony riot. Large clusters left the main body of the rally and surrounded the police, prompting tense stand-offs as the police removed those under arrest.

"Stay together," Katrina Plotz, an organizer with the Anti-War Committee, screamed from the stage. "They’re trying to steal our protest — we have to ignore the police intimidation."

What became a battlefield here in the streets of St. Paul began with a series of sit-ins, as impenetrable police lines continually stifled marchers not looking for a serious fight with police. Frustrated with repeatedly being halted — a slow process in which police used horses to divide groups and arrest only some protesters — demonstrators engaged in an improvised maverick march that went wherever it could, for as long as it could.

Now, in the quieter moments between concussion bomb blasts that pushed the group toward its ultimate fate in the Ramsey County Jail, a small debate broke out among some of the protesters about how effective their direct action was at this RNC.

"It makes sense at a WTO conference like Seattle in 1999, where policymaking can actually be halted," one said of the police presence. "But more than anything else the RNC is ceremonial."

Still, as the police ultimately herded this crowd onto a bridge that police then blocked on both sides before placing everyone under arrest, it was clear those here tonight were angry. Judging from chants throughout the week, most felt they could not meaningfully participate in the political system in any other way. They obviously wanted to be heard.

"The whole world is watching! The whole world is watching!" they shouted as police shot pepper spray into the crowd, forcing its last few steps onto the bridge.

Learning the Lessons of Iraq

NEW YORK – The Iraq war has been replaced by the declining economy as the most important issue in America’s presidential election campaign, in part because Americans have come to believe that the tide has turned in Iraq: the troop “surge” has supposedly cowed the insurgents, bringing a decline in violence. The implications are clear: a show of power wins the day.

It is precisely this kind of macho reasoning that led America to war in Iraq in the first place. The war was meant to demonstrate the strategic power of military might. Instead, the war showed its limitations. Moreover, the war undermined America’s real source of power – its moral authority.

Recent events have reinforced the risks in the Bush administration’s approach. It was always clear that the timing of America’s departure from Iraq might not be its choice – unless it wanted to violate international law once again. Now, Iraq is demanding that American combat troops leave within twelve months, with all troops out in 2011.

To be sure, the reduction in violence is welcome, and the surge in troops may have played some role. Yet the level of violence, were it taking place anywhere else in the world, would make headlines; only in Iraq have we become so inured to violence that it is a good day if only 25 civilians get killed.

And the role of the troop surge in reducing violence in Iraq is not clear. Other factors were probably far more important, including buying off Sunni insurgents so that they fight with the United States against Al Qaeda. But that remains a dangerous strategy. The US should be working to create a strong, unified government, rather than strengthening sectarian militias. Now the Iraqi government has awakened to the dangers, and has begun arresting some of the leaders whom the American government has been supporting. The prospects of a stable future look increasingly dim.

That is the key point: the surge was supposed to provide space for a political settlement, which would provide the foundations of long-term stability. That political settlement has not occurred. So, as with the arguments used to justify the war, and the measures of its success, the rationale behind surge, too, keeps shifting.

Meanwhile, the military and economic opportunity costs of this misadventure become increasingly clear. Even if the US had achieved stability in Iraq, this would not have assured victory in the “war on terrorism,” let alone success in achieving broader strategic objectives. Things have not been going well in Afghanistan, to say the least, and Pakistan looks ever more unstable.

Moreover, most analysts agree that at least part of the rationale behind Russia’s invasion of Georgia, reigniting fears of a new Cold War, was its confidence that, with America’s armed forces pre-occupied with two failing wars (and badly depleted because of a policy of not replacing military resources as fast as they are used up), there was little America could do in response. Russia’s calculations proved correct.

Even the largest and richest country in the world has limited resources. The Iraq war has been financed entirely on credit; and partly because of that, the US national debt has increased by two-thirds in just eight years.

But things keep getting worse: the deficit for 2009 alone is expected to be more than a half-trillion dollars, excluding the costs of financial bail-outs and the second stimulus package that almost all economists now say is urgently needed. The war, and the way it has been conducted, has reduced America’s room for maneuver, and will almost surely deepen and prolong the economic downturn.

The belief that the surge was successful is especially dangerous because the Afghanistan war is going so poorly. America’s European allies are tiring of the endless battles and mounting casualties. Most European leaders are not as practiced in the art of deception as the Bush administration; they have greater difficulty hiding the numbers from their citizens.

The British, for example, are well aware of the problems that they repeatedly encountered in their imperial era in Afghanistan. America will, of course, continue to put pressure on its allies, but democracy has a way of limiting the effectiveness of such pressure. Popular opposition to the Iraq war made it impossible for Mexico and Chile to give into American pressure at the United Nations to endorse the invasion; the citizens of these countries were proven right.

But back in America, the belief that the surge “worked” is now leading many to argue that more troops are needed in Afghanistan. True, the war in Iraq distracted America’s attention from Afghanistan. But the failures in Iraq are a matter of strategy, not troop strength. It is time for America, and Europe, to learn the lessons of Iraq – or, rather, relearn the lessons of virtually every country that tries to occupy another and determine its future.

Green and red

Now that the Iraq War and occupation is accepted as a permanent feature of American life, it seems worthwhile to reflect on how controversial it once was — not just among the millions who filled streets around the world to protest the impending invasion, but also within the governments of some of America’s traditional allies. No one better expressed the rift it created in Europe than German Foreign Minister Joschka Fischer when he publicly rejected Donald Rumsfeld’s appeal for support at the February 2003 Munich security conference. Lest the then Secretary of State miss the point, Fischer switched to English for his summation: "Sorry, you haven’t convinced me."

It’s unlikely Rumsfeld was particularly surprised, except possibly by Fischer’s command of English, since the German government so clearly owed its come-from-behind reelection the prior September to the vehemence of its opposition to the upcoming war. At the time, George W. Bush opted against making the traditional congratulatory call to Socialist Party Chancellor Gerhard Schröder, and Condoleezza Rice declared that Fischer’s "background and career do not suit the profile of a statesman." Given Rice’s history as a Stanford professor and Chevron corporate board member, such a remark makes perfect sense. Fischer, leader of the Green Party — the coalition government’s junior partner — was not only a high school dropout but a veteran militant street protestor of the German new left that demanded that its parents’ generation confront the Nazi legacy while vehemently opposing the US war on Vietnam.

In Joschka Fischer and the Making of the Berlin Republic (Oxford University Press, 400 pages, $35), journalist Paul Hockenos explores the life, beliefs, decisions, and actions of Germany’s recent Foreign Minister. For example, although the Greens are widely considered a pacifist party, Fischer was not a pacifist — after a few small leftist groups had taken to kidnapping and assassination in the 1970s, he once gave a speech urging the movement to "put down the bombs and pick up stones again."

As Hockenos explains, Fischer was the most prominent of the German "68ers" who considered themselves to the left of the Socialists and who fashioned something of an "anti-party party" with the Greens in order to embark upon a "long march through the institutions." During his 1998–2005 tenure as Germany’s Foreign Minister, Fischer became the country’s most widely admired politician, although the Greens never surpassed single-digit percentages of the national vote. Still, his legacy — and the party’s — is mixed. The "Red-Green" government engineered Germany’s first military intervention since the end of World War II, when German pilots participated in the bombing of Kosovo. Just as it took Germany’s Socialists time to realize they could form a government of the left if — and only if — they did so in coalition with the Greens, the Greens are in opposition today because they have been unwilling and unable to coalesce with other factions.

Nonetheless the post-’60s German left did at least set itself on an identifiable course of action. In this respect, Joschka Fischer and the Making of the Berlin Republic makes an excellent case that Americans can learn from Europe.

The filth and the fury

Apologies to all Nathaniel Hawthorne and Herman Melville fans out there, but the American novel didn’t get good until it shook off the last vestiges of Puritanism and risked a certain shock factor. It wasn’t just the authors pushing potentially offensive social-realist (Stephen Crane, Theodore Dreiser, Upton Sinclair) or unflattering social-elite-portraiture boundaries (Edith Wharton, Henry James, etc.) who made the upstart nation’s lit suddenly comparable to the Old World’s new output. By the dawn of the 20th century, non-rabble-rousing Yank fiction (not to be confused with today’s street-corner favorite tabloid, Yank) had also matured stylistically. Still, it’s those "dirty books" that somehow still stick out in well-read readers’ back pages. American censorship battles in the 20th century were, until well into the sexual revolution, largely fought on literary terrain.

Barney Rosset, the subject of new documentary Obscene, should be canonized by First Amendment fans as the patron saint of key mid-20th-century obscenity cases. As founder of Evergreen Review and Grove Press, this "smut peddler" published everyone from Harold Pinter to Octavio Paz to Kathy Acker, as well as a whole lot of unapologetic porn (mostly the Victorian kind). No wonder Rosset was behind some of the central court struggles against censorious US standards for both literature and movies. He consorted with yippies and Black Panthers, produced close friend Samuel Beckett’s only film (1965’s Film), and was called a "tragic hero" by his own analyst (one of many). He is an interesting enough guy that one wishes codirectors Neil Ortenberg and Daniel O’Connor’s admiring portrait was longer — it gets the career highlights down but barely touches on what sounds like an equally colorful personal life.

Weaned on the radicalism of Depression-era East Coast experimental schools, Rosset was an Army combat cinematographer during World War II. He returned home to produce 1948’s virtually unknown Strange Victory — a movie about American racism so incendiary that only one New York City theater would consent to show it. Having been checked out by the FBI as a possible "Communist filth racketeer" while in grammar school, he was on familiar ground when he commenced the first of many legally challenged literary ventures in the late 1950s. Evergreen Press republished Allen Ginsberg’s suppressed epic poem Howl; Grove launched US printings of D.H. Lawrence’s Lady Chatterley’s Lover and Henry Miller’s Tropic of Cancer, both already decades-old yet still banned on our shores. Other causes célèbres included William S. Burroughs’ Naked Lunch, The Autobiography of Malcolm X (published just after his assassination), and Che Guevara’s diaries (which angered somebody enough to get Grove’s offices bombed).

As if this wasn’t drama enough, Rosset’s business and personal fortunes experienced considerably more disorder as the turbulent ’60s turned into the oversatiated ’70s. Importing a Marxist quasidocumentary art film from Sweden, 1967’s I Am Curious (Yellow), made cinema safe for sex after protracted court battles. It also made millions, which perversely hurt Grove in the end — forcing an expansion that proved disastrous, particularly when 1968 sequel I Am Curious (Blue) bombed. The CIA put Rosset under surveillance and women’s liberationists assailed his catalog as sexist, yet threatening calls and sniper fire at his home did not exactly discourage his alcohol and amphetamine abuse. He was even fired from Grove itself after a supposedly friendly takeover.

Too bad Obscene just skims over the less-public chapters in its subject’s life, like his four marriages. Now a dapper and delightful old man, Rosset has long since burned through the last of many fortunes made and lost. He’s broke but blithe about it, as if cocooned by admiration — the eccentric lineup of praise-singing interviewees here include Jim Carroll, John Waters, Amiri Baraka, Erica Jong, and Gore Vidal. Perhaps the best testaments to Rosset’s character, however, are priceless excerpts from a cable-TV interrogation in which he responds to actual smut peddler Al Goldstein’s exasperatingly crude questions ("How do you get sucked into marriage?" being the least of them) with charming, earnest self-examination.

REVIEW Somewhat eclipsed by the mob scene upstairs at "Frida Kahlo," the San Francisco Museum of Modern Art’s "The Art of Lee Miller" abounds with riveting images — not least those of the late photographer herself, who was, at different times, a nude model for her father, a high fashion mannequin for Vogue, and a muse and collaborator for her onetime lover Man Ray. Many will fix in your mind long after this sizable show ends — the tattered window into an otherworldly Egypt of Portrait of Space (1937), the chorus line of dangling rat posteriors in Untitled (Rat Tails) (1930), and the persistently chic English ladies in wartime protective headgear of Women with Fire Masks, London (1941).

But two Miller images — sensational were they not so sober — bid you return to examine them further: The Suicided Burgermeister’s Daughter, Leipzig, Germany (1945) and Untitled [Severed Breast from Radical Mastectomy] (circa 1930). Both play morbidly within the haunted dreamscapes of surrealism, teasing out a certain tongue-in-cheek formalism, or, in the case of the portrait of the deceased fräulein, upend classical aesthetic values with a detachment that’s chilled to the bone and coolly black-humored.

Experimenting with architecturally focused abstraction, dadaism, and surrealism in the early ’30s, during her Parisian tryst with Man Ray, Lee said she was working as a medical photographer in the city when she managed to spirit away a breast amputated in a mastectomy operation from a local hospital. Back at the studio she photographed it two ways: once with its sagging skin-side exterior facing her camera, and again with its gory innards threatening to spill out like kidney pie. In both images the breast lies in an elegant ivory plate on a creased, innocuously striped, lightly grid-printed place mat, with a fork and knife laid out for an imagined meal. The two perspectives on print are displayed side by side, as if to ironically mimic the natural placement of these mammaries. If not for the card, one would mistake the slab on the plate for a somewhat unappetizing kidney pie or pig’s ear. Whitney Chadwick, the author of Women Artists and the Surrealist Movement (Thames & Hudson, 1991), described Miller re-envisioning this breast "not as an object of male desire, but as dead meat," and it does seem as if Miller sought to load these life-giving symbols of nurturance and desire with connotations of vulnerability and sacrifice. She takes the dismembered body part’s symbolism to its bitter end — while referencing the common surrealist obsession with those primal glands as well as the Catholic iconography of St. Agatha, who is often pictured proffering her plated breasts to devout viewers. The frequently and easily commodifiable body parts are served up for your visual consumption.

Exhibition catalog author Mark Haworth-Booth points to the surrealist notion of "convulsive beauty" and the movement’s general fascination with effigies in reference to Miller’s stunningly lit and composed The Suicided Burgermeister’s Daughter, shot during her tenure as the only female photojournalist allowed into combat during World War II. The body’s hair, skin, brow, pretty lids, and steepled nose evoke the eternal appeal of an angel aloft above a headstone. Her arms caress the front of her heavy wool Nazi nurse’s coat. Her lips, unnaturally pale and marble-like, are slightly parted, revealing perfect teeth with a whiff of inadvertent eroticism, and she lies on a leather couch — on which the one distended button and a small rip in the leather arm are the only hints of decay.

Most intriguing, Miller seems to have blurred the area above the body, making it appear as if a fine mist or fog is descending on the prone form. In the accompanying original dispatch for Vogue, the magazine she once posed for and later reported for, Miller writes of "the love of death which is the under-pattern of the German living caught up with the high officials of the regime," text that went unpublished in the magazine. The careful formality of Burgermeister’s Daughter‘s composition brings to mind and counterpoints those of more recently deceased Germans: Gerhard Richter’s paintings of the also-suicided members of the Baader-Meinhof gang. Yet, with Burgermeister’s Daughter and Untitled, it’s hard to imagine another artist so associated with the temporal flash of fashion making images as powerful and as fueled by the death urge.
