SAT IN YOUR LAP: THE LATEST DAUGHTERS OF KATE BUSH FLESH OUT THIS WOMAN’S WORK

Kate Bush was gifted with a fierce female originality at a time when the rock world was starved of it: her golden run of eccentric achievement in the late 1970s and early 1980s placed her next to Joni Mitchell in terms of adventurous — if not always intellectual — influence in the minds of aspiring young women singer-songwriters. (And there’s some extremely perverse pleasure to be taken in the little factoid that her stunning 1985 EMI comeback album Hounds of Love snatched the top U.K. album slot from Madonna’s Like A Virgin.)

But that gift was also a curse: Bush was so original in so many ways that it’s easy to forget the myriad musical pathways she forged. This “artist in a female body” — as she famously protested when her panicked record company started pimping her rack on sleeves to shift units — has mostly been boiled down to spiritual oracle, swooping-voiced Sybil, and, ever since concept albums by women were banished to exile in Guyville, keeper of the idiosyncratic prog-rock flame. In other words, Stevie Nicks with a Fairlight synthesizer and a degree in Celtic mythology. Or else just plain weird.

Fortunately, musical weirdness is so much with us today that other Bush qualities are starting to be glimpsed through the babushka, including her production abilities, precocity, sincerity, humor, and unabashed gender-fucking. For the past three decades, it’s never been rare for artists to be compared to Bush — mostly for childlike vocalizations or way with a silver space suit and Circe metaphor. But in our post-neo-neo-soul moment (sorry Wino), a new crop of female British singers has arisen that takes its cues, mostly acknowledged, from Bush’s kaleidoscopic talent.

FLORENCE AND THE MACHINE

Without Kate Bush, flouncy freak-folker Florence Welch and her ever-changing backup band could be heard as a product of the unholy union of Devendra Banhart and Tori Amos — except those two probably wouldn’t exist without Bush either. Florence grounds her lyrics in the sexually frantic Bush. “I must be the lion-hearted girl,” she sings in the vid for “Rabbit Heart (Raise It Up)” just before her wedding banquet table folds up into her coffin.

MARINA AND THE DIAMONDS

Marina and the Diamonds, a.k.a. the singular singer Marina Diamandis has been gaining huge traction with her excellent “I Am Not A Robot” track, calling up the more vulnerably affirmative, “Don’t Give Up” Bush. But it’s her screwy, cuckooing “Mowgli’s Road” that effectively conjures up woozy Kate at a post-rave bonfire.

BAT FOR LASHES

Half-Pakistani lovely Natasha Khan works the gleaming edge of Bush’s dark underworld glamour, and grounds her post-goth balladry and soft electro sparks in the sensual world. Her single “Daniel” de-Eltons the title character and places him among Bush’s slightly menacing, jig-footed cosmic effigies.

MICACHU AND THE SHAPES

Mika Levi calls herself Micachu and spits out shiv-sharp blasts of dissonant micro-punk — seemingly the opposite of Bush’s epic dramas. But Levi echoes Bush both in the sheer Englishness of her lyrics, the knockout oddity of her instrumentation and starry-eyed gender-bending. Micachu’s rambunctious, exhilarating new album Jewelry (Rough Trade) could easily have been shaken out of Bush’s backing track outtake archives.

MOTHER STANDS FOR COMFORT: KATE BUSH IN THE SOUNDS OF NOW

It’s always exciting when you sense universal consciousness in motion. Like so many around me lately, I can’t stop listening to Kate Bush. I play Hounds Of Love (EMI, 1985) from start to finish again and again, allowing a different song from the album to become my theme or guiding light for weeks at a time. I play The Dreaming (EMI, 1982) and let it spin in and out of my head. These songs are as dramatic as they are sincere. They conjure magic while maintaining an emotional core. Bush’s undeniable integrity travels through her songs like a force of nature, from soft-lit soap opera to primal realms.

Many great records by other artists in the last few years have been stamped with undeniable Kate Bush moments. A new generation of musicians is learning that avant and pop sensibilities can coexist in exciting ways and that it is possible to blend the organic and the mechanical to create songs that soar with a mission. Here are some of today’s cloudbusters.

City officials are considering shutting down the municipal asphalt plant — the source of material for repaving roads and fixing potholes — in order to facilitate construction of a private plant on the waterfront that the city would agree to help finance and support over the long term.

While the privatization plan is being billed by project proponents as a way to save money during tough financial times, it raises questions about whether relying on the private sector for this essential material could hurt the city’s ability to make emergency repairs and ultimately end up costing taxpayers even more.

For the cash-strapped Port of San Francisco, which will make millions of dollars leasing land for the new facility, this is unquestionably a good deal. But for the rest of the city, which is losing a potentially valuable public resource it has operated since 1909 when the first municipal plant opened, the answer is a bit less clear.

Douglas Legg, manager of finance and budget at the Department of Public Works (DPW), argues that the municipal plant is not cost-effective and that the city would pay less if it contracts with an outside vendor. In a 2006 study, Legg found that the city’s cost to produce a ton of asphalt was $75 while private plants offered it for $67.

"It’s true that E.B.I. Aggregates and Graniterock are a little cheaper because they have a market advantage: they own their own gravel quarries," admits Ben Santana, who has managed the municipal plant in the Bayview for the last 21 years. But he still thinks his facility plays an important role. "Otherwise they would have gotten rid of us long ago. We can mobilize in a few hours and city trucks don’t have to wait in line with other clients."

In the aftermath of the 1989 Loma Prieta earthquake, the municipal plant proved to be a valuable asset. "The plant wasn’t damaged. We sent our crews to take care of cracks and voids that had suddenly opened up," Santana recalls. "So the city didn’t have to go south to get material, or pay to get the private plants to open."

Indeed, in 2006, DPW held off the proposed shutdown in order to maintain its access to asphalt in emergencies. Officials worried about being dependant on plants outside city limits, especially since E.B.I. in Brisbane was slated to cease operations in the upcoming years, which would have left Graniterock potentially enjoying a monopoly that could result in price increases.

Although the agency recognizes that it has to have an asphalt plant inside city limits to function well, it is losing the political will to maintain its own. So when port officials approached DPW with their plan to attract a private asphalt operator, the threat to close down the municipal plant resurfaced.

The port has issued a request for proposal (RFP) for an asphalt-batching plant to be built on Pier 94. The selected bidder would be bound to negotiate a long-term contract with the city guaranteeing it would supply asphalt at a price tied to the Northern California asphalt price index.

The port and DPW assume the potential market for asphalt in the city will be large enough to draw private operators. But that belief seems to contradict the rationale behind the decision to close the municipal plant in the first place, which was that it couldn’t produce volumes large enough to bring the price per ton down.

"The demand from the street resurfacing program was nowhere near as high as we thought it would be," Legg says. In 2004, DPW installed two silos on the site to store hot asphalt and increase production. DPW was hoping to generate additional revenue for the department by selling asphalt to private contractors and other agencies. But two years later, Legg concluded in his report that the plant not only failed to turn a profit, it was facing a $100,000 shortfall to repay its investment.

Demand might be picking up, though: city officials expressed their intention to make up for years of neglect in the upkeep of San Francisco streets by introducing a $368 million safe street and road repair bond measure for the November ballot. The plan would boost the number of blocks to be resurfaced from 100 to 400 for the next 10 years, something that might make the city-owned plant more cost-effective. But Legg skeptically points out that the plant still requires replacement of some key components.

"Last year we had a $60 million capital budget for all capital improvement needs in the city from the general fund sources. This year, we’ve got $22 million," Legg says. "They’re scarce dollars. I can’t speak for what the Board [of Supervisors] will chose to do, but it’s challenging to get capital money."

Legg also noted the city plant’s "frequent breakdowns" and limited capacity to store raw materials, criticism countered by Santana. "The plant was modernized in 1993. Sure, some equipment does date to 1953, and I’ve been pushing to replace them for years. But it’s nothing the city can’t afford. Yes, it does sometimes go down. That’s part of operating a plant. But we’ve never run out of material because I always make sure to have some on ground or en route."

Brad Benson, project manager at the Port of San Francisco, discounts the recent limited asphalt consumption in the city, noting major development proposals in the city’s future. "Think about shipyard development, Treasure Island development, Caltrain, parking lots," Benson says. "If there’s not the demand, there won’t be bids. No one is going to invest $3 [million] to $10 million, whatever it costs to build an asphalt plant, if they don’t perceive a market."

But what might also hook prospective bidders is the provision, stated in the RFP, that the "risk capital to construct the facility (may be offset by city financing)." Benson explains that "this concept was introduced here in the midst of the financial crisis when people were having trouble finding sources of capital. The city may have access to some lower cost sources of debt."

Benson said he doesn’t know if city financing would be needed. "Obviously, the port prefers bidders that come in with their own sources of financing. That has been the model to build the neighboring concrete plants. The only reason to consider it is if the city combines lower-cost financing and could get lower cost asphalt in return. Then it might be worth doing."

It’s an interesting paradox: the city wouldn’t have funds to upgrade its plant, but would be ready to chip in to outsource?

But there are other issues driving the proposal. Karen Pierce, a Bayview- Hunters Point community activist who sits on the port’s Southern Waterfront Advisory Committee, told us she would "like to see the municipal plant move away from where people live. There needs to be a buffer area. A newer plant on port property would be further away, and we would have the opportunity to make sure it uses technologies that reduce the amount of pollution."

The municipal asphalt plant, which has never received complaints for pollution, currently incorporates 15 percent of recycled asphalt in its production. The RFP requests its potential tenant raise this amount up to 45 percent.

The proposed lot is also three times bigger than the existing one on Jerrold Avenue and has the advantage of being located near a maritime terminal where sand and gravel, the aggregates mixed with tar to produce asphalt, are imported. Also, there are two concrete batching plants and a construction material recycling center in the vicinity.

"Co-locating businesses that share each other’s products and reducing long-haul truck trips are the kernels of a broader idea for an ecoindustrial park that the port is developing in this area of the waterfront," Benson says.

If the asphalt plant project falls through, the port does have a backup plan: it is considering leasing the site to yet another concrete plant. Bids on both proposals are due in September, after which the Board of Supervisors will consider whether to close the city’s plant.

Nip it in the bud

GREEN CITY Imagine if San Franciscans had the choice of sending the check for their monthly electricity fees to one of two places. Option A is a massive private utility company, serving up fossil fuel-fired and nuclear-powered energy, presided over by a CEO who got paid nearly $9 million last year. Option B is a publicly-owned program run by local government that offers a substantial percentage of green electricity from sources such as wind, solar, and tidal power. In San Francisco, which one would people be more likely to pick?

The intent behind community choice aggregation (CCA) programs, which in San Francisco is known as Clean Power SF, is to make Option B a reality. If successful, the program would signify not just a major advance on the green front, but a dent in Pacific Gas & Electric Co.’s longstanding monopoly in the Bay Area.

The program development is inching along under the direction of the San Francisco Public Utilities Commission and the Local Agency Formation Commission (LAFCo). Sup. Ross Mirkarimi, who chairs LAFCo, has poured a tremendous amount of time and energy into the city’s fledgling CCA program.

So when a proposed state ballot initiative surfaced that threatens to thwart statewide CCA programs before they launch, Mirkarimi came out swinging hard.

Titled the "Taxpayers Right to Vote Act," the proposed initiative would require that any effort to create or fund a CCA program be ratified by two-thirds of the voters. The measure would erect an almost impossibly high barrier to CCA development around the state, effectively snuffing out PG&E’s would-be competition and sullying local governments’ plans to embrace publicly-owned, cleaner energy alternatives.

Mirkarimi wasted no time in drafting a resolution against the measure and submitting it to the Board of Supervisors, telling his colleagues that the utility’s proposal undermines years of effort "to allow municipalities to go ahead and chart their own energy destiny so they don’t have to be on the syringe of fossil fuel-driven corporations like PG&E."

He also took issue with the name of the proposal, calling it deceptive and misleading. "The point is that we should not be manipulated by measures such as this, where voters would be required to have a two-thirds vote on something the state Legislature has already allowed us to pursue," Mirkarimi said. "It’s our own right, and corporate special interests shouldn’t dictate otherwise." The state law that grants local governments the right to pursue community choice aggregation, which was sponsored by then-Sen. Carole Migden, specifically prohibits actions that impede the progress of a CCA.

PG&E’s name does not appear anywhere on the ballot-initiative proposal, but a spokesperson for the initiative confirmed that the utility had paid the submission fee. The law firm listed as a contact for the proposal, meanwhile, has been enlisted by PG&E before. And Robert Lee Pence, who is named as the proponent of the initiative, has teamed up with PG&E ally Townsend, Raimundo, Besler and Usher on campaign measures in the past. That Sacramento-based political consulting firm describes its strategic consulting services online with this brazen slogan: "Moving opinions is what we do best."

PG&E did not return calls for comment.

At the June 30 Board of Supervisors meeting, supervisors approved Mirkarimi’s resolution on a 10 to 1 vote, with Sup. Michela Alioto-Pier voting no. And while a resolution does little more than create a formal record of the board’s position on a matter, Mirkarimi seemed to suggest that it was only the start of a battle mounting against this proposal. "Don’t be surprised [if] a number of municipalities align themselves in potential litigation against this," he said.

Sup. David Campos, an attorney who also sits on LAFCo, hinted that the city could enter into litigation on the issue. "I hope the city is carefully looking at legal issues that might be raised by the actions of PG&E," he noted at the June 30 Board meeting. "I think that there are legal protections we need to avail ourselves of, and I hope the City Attorney’s Office, working with the Board of Supervisors, can make sure that the city takes all steps that it needs to take to protect its legal rights."

Campos later told the Guardian that he had not yet spoken with the City Attorney’s Office about it.

When asked about pursuing legal action, the City Attorney’s Office would only say that "we’re aware of it, and we’re evaluating what we will be doing," according to spokesperson Jack Song.

Barbara Hale, general manager for power at the San Francisco Public Utilities Commission, told the Guardian, "We have certainly been talking with other cities about the initiative." But Hale added that the agency hadn’t taken a formal position yet because it is so early in the process. "It hasn’t actually been placed on any ballots yet."

Since the initiative was submitted, public power activists across the state have taken notice. Jeff Shields, general manager of the South San Joaquin Irrigation District, has gone toe-to-toe with PG&E on public power issues before. One of the most memorable battles occurred when a political consulting firm hired by PG&E hacked into SSJID’s computers in the midst of a tug-of-war over control of the area’s electricity infrastructure — only to get caught by the FBI and publicly denounced by PG&E. "Obfuscation is PG&E’s middle name," Shields says. "I know there are lots of people looking at this initiative, but I don’t know that there’s a specific organizational effort against it at this time."

Jerry Jordan, executive director of the Sacramento-based California Municipal Utilities Association — a statewide organization representing 70 public utilities — told the Guardian that CMUA would oppose the initiative. However, "we may wait until it qualifies," Jordan said. The initiative is still in its earliest stages, and the attorney general has yet to certify it as legal to the secretary of state.

Meanwhile, efforts to move forward with the CCA model in other regions are floundering in these tough fiscal times. The San Joaquin Valley Power Authority voted June 25 to temporarily suspend its CCA, an effort in the works for years that had a goal of offering electricity to customers at lower and more stable rates.

Spokeswoman Cristel Tufenkjian said the greatest obstacle was a contract with CitiGroup’s energy branch that was marred by tight credit markets. "When things started to go south with the markets, CitiGroup said it could not execute that contract," Tufenkjian explained. She also added, "We are opposed to the initiative."

The SJVPA bid to create a CCA was also hindered by opposition from PG&E. "For the last few years, PG&E has continually placed roadblocks in front of our program in an attempt to stop us from implementing community choice and ultimately not providing residents and businesses the opportunity to have a choice about who will provide them electrical energy," said Ron Manfredi, city manager of Kerman and chair of the San Joaquin Valley Power Authority.

The Board of Supervisors’ resolution against the ballot initiative condemns such roadblocks and vows to push through this one. "PG&E has a history of acting to maintain its monopoly in its service region, including opposing public power initiatives at the ballot and lobbying officials of California cities [and] counties against community choice aggregation in apparent violation of the provisions [of state law]," the text of the resolution reads.

As this ballot initiative moves through the approval process, it’s clear that a battle is going to heat up very quickly. "I think we have to fight this as hard as we can," Campos told us. "PG&E has been unsuccessful in killing [CCA] here in San Francisco, but they have certainly delayed it. Now they’re trying to make sure it doesn’t happen anywhere else."

Father Miguel’s homily

Editor’s Note: Nick Buxton covered the June 24-26 United Nations Conference on the World Financial and Economic Crisis and Its Impact on Development for the Guardian.

Shuffling into the room, Miguel d’Escoto Brockmann, informally known as Father Miguel, is every bit the avuncular priest — squinting through his glasses, saying we all need to take Jesus’ message of love more seriously.

At 76, the U.S.-born naturualized Nicuarguan citizen doesn’t look like a major threat to the established economic order. But as the elected president of the United Nations General Assembly, d’Escoto has touched a raw nerve among the world’s most powerful nations.

Since late May, European Union and U.S. negotiators have accused him of putting the entire U.N.’s credibility at stake. In the May 24 New York Times article "At U.N., a Sandinista’s Plan for Recovery," reporter Neil MacFarquhar accused Father Miguel of "serious delusions of grandeur." At the end of June, the criticisms reached a loud crescendo as the whole United Nations met for a summit on the global economic crisis.

Last September, d’Escoto was unanimously elected to the one-year presidency. Typically seen as a low-profile convener, d’Escoto, a former foreign minister for Nicaragua under the left-wing Sandinista government, soon showed his colors when he openly condemned U.S. "acts of aggression" in Iraq. When the financial meltdown occurred in October 2008, d’Escoto convened a high-level commission chaired by Nobel Prize winning economist Joseph Stiglitz and started to organize a U.N. conference on the global economic crisis.

He also started to deliver presentations, more like priestly homilies, that challenged the "pandemic selfishness and egotism" that led to the economic crisis and warned of ecological collapse and the need for a renewed veneration for "Mother Earth."

Yet despite the rich nations’ best attempts to isolate him politically, many of d’Escoto’s reform proposals received support from the misnamed Group of 77 nations — which actually represents more than 130 developing nations. D’Escoto made clear his decision to side with the majority against a false unity with a powerful minority: "The U.N. is made up of 192 countries …. I criticize the rich countries, made up of about 25 countries, because they don’t represent the majority but pretend they do…. We must ensure those countries most affected by the crisis have a voice in resolving the crisis."

D’Escoto’s role reflects the emergence of a more confident and powerful southern hemisphere, with nations like India and China presenting an economic challenge to traditional powers in the northern hemisphere and with Latin America posing a vocal political challenge through the likes of presidents Hugo Chavez of Venezuela and Rafael Correa of Ecuador.
Many point out that the United Nations charter (drawn up in San Francisco in 1945) gives the job of global economic coordination to the United Nations Economic and Social Council. Yet this job was usurped by the International Monetary Fund and the World Bank, which are largely controlled by the U.S. Treasury. The Obama administration’s U.N. representative John Sammis’ assertion at the recent U.N. Conference that it believes "any decisions on reform of the international financial institutions or the manner in which they conduct their business are the prerogative of their shareholders and their respective boards of governors" is clearly a blatant rear guard attack on d’Escoto’s efforts to bring democratization to the global economic system.
Beyond the geopolitics, d’Escoto’s probing challenge to the world’s economic powers also gives voice to a breakdown of faith in the credos of free markets, unlimited economic growth, and living to consume. His homilies may occasionally be esoteric, but when d’Escoto proposes the creation of a Global Economic Council or speaks to the importance of values such as solidarity, compassion, and cooperation, they seem much more lucid than the U.S. determination to continue with "business as usual."

Bicyclists throughout the city cheered as the San Francisco Municipal Transportation Agency board unanimously approved 45 new bike-network improvement projects June 26, a move that was hailed as a major step forward for cyclist safety on city streets and a win for the environment.

In a historic decision, SFMTA accepted the findings of an environmental impact review associated with the long-stalled San Francisco Bike Plan and green-lighted almost all of its near-term project proposals, a decision that could trigger the construction of 34 new miles of bike lanes throughout the city starting as early as August.

Plans also call for innovative improvements such as colored bike lanes, converting on-street parking spaces from cars to bikes, thousands of new bike racks, and an effort to ramp up education about safety for bicyclists and motorists. Three years after a court injunction came down on bike-network improvements in the wake of a lawsuit for failing to conduct a full EIR, the board’s vote was widely applauded as a pivotal moment for bicycling in San Francisco. Now that the EIR has been adopted, the process of lifting the injunction has been set in motion.

The vote followed more than three hours of testimony from avid San Francisco cyclists, who asked for more bike lanes and greater accessibility for would-be bicyclists such as children and seniors. Fewer than 20 people turned out in opposition and most people on the thumbs-down side voiced their general support for enhanced bike lanes, but took issue with some flawed aspects of one of the projects.

For a comprehensive design that could ultimately remove more than 2,000 parking spaces from city streets to accommodate bicycle infrastructure, there was remarkably little discussion about the loss of parking.

An old familiar debate about bikes vs. cars continues to grind away — but even Mayor Gavin Newsom called this squabble a thing of the past, touting the Bike Plan as progress for San Francisco and focusing his comments at a press conference on sustainability and livability instead the competition for space on city streets.

IF YOU BUILD IT …


Moments after the MTA Board announced its decision, a crowd of die-hard bike enthusiasts from the San Francisco Bicycle Coalition exchanged hugs and congratulations outside the City Hall hearing room. The vote was hailed as a major, hard-won victory.

"This is a momentous day for better bicycling and a better San Francisco," said Leah Shahum, executive director of the 10,000-member organization. The city "has taken a significant step forward in proving its commitment to smart, sustainable transportation choices, and we expect to see the numbers of people choosing to bicycle to increase dramatically."

Still, there are undoubtedly some who only expect to experience a dramatic increase in frustration when looking for a parking space. There are 880 lane-miles of streets in San Francisco’s roadway network, and according to SFMTA spokesman Judson True, a total of 880 parking spaces throughout the city would’ve been removed if the MTA Board had approved all 46 Bike Plan projects. (The board okayed 45 out of 46 projects; the hotly debated Second Street project, which would have stripped out a handful of parking spaces to accommodate bike lanes, was continued for further study.)

Amid the hundreds of pages of comments submitted during the EIR process was a complaint that the Bike Plan — often touted as a win for sustainability — could adversely impact San Francisco’s air quality by causing more drivers to circle in search of parking.

"More time will be spent by persons in cars as a result of a lack of on-street parking (already at a critical lack of capacity) searching for an available parking spot or stuck in traffic jams due to removal of car traffic lanes," one member of the public complained.

In response, the EIR points to San Francisco’s Transit First policy, which essentially says that the city will provide more of an incentive to take public transit than drive. "The social inconvenience of parking deficits, such as having to hunt for scarce parking spaces, is not an environmental impact," the EIR notes. "There may be secondary physical environmental impacts such as increased traffic congestion at intersections, air quality impacts, safety impacts, or noise impacts caused by congestion. In the experience of San Francisco transportation planners, however, the absence of a ready supply of parking spaces, combined with available alternatives to auto travel … induces many drivers to seek and find alternative parking facilities, shift to other modes of travel, or change their overall travel habits. Any such resulting shifts to transit service in particular, would be in keeping with the city’s Transit First Policy."

The underlying idea is that the Bike Plan can help to clear the air, fight climate change, and boost public health by making it more convenient to go without a vehicle — and more of a headache to drive.

As one commenter pointed out, the Bike Plan could also make life easier for people with disabilities who have to drive by replacing cars with bikes and thus freeing space in traffic lanes.

BRAKING THE HABIT


There are, of course, many sound arguments for nudging people away from driving. At a June 26 press conference, Newsom noted that 54 percent of the city’s greenhouse-gas emissions are related to vehicle traffic on the city’s roadways — and reducing those carbon emissions would go a long way toward making the city more climate-friendly, not to mention healthier for cyclists and non-cyclists alike.

Meanwhile, Bert Hill, chair of the city’s Bicycle Advisory Committee, noted that 40 percent of car trips in the city cover two miles or less, a distance easily traversed by bicycle. If more people opt to go by bike, the result could be calmer traffic, cleaner air, and possibly a boost for business. "No one goes shopping on the highway," one commenter pointed out during the SFMTA Board hearing. For all of these overarching benefits to be realized, of course, many motorists will have to change their behavior by electing to leave the car at home.

The San Francisco Bicycle Coalition points to evidence suggesting that many frequent drivers are in fact ready to transform into frequent bicyclists. "New bike lanes will … attract tens of thousands of new bicyclists," an SFBC press release noted. "More than one-third of San Franciscans say they would ride if streets had more bike lanes and were more inviting for bicycling."

Newsom sounded a similar note, calling the Bike Plan "inevitable" and asserting that the debate that "used to be framed in terms of two wheels vs. four … that is behind us." Instead, he added, it’s time for "a new narrative of collaboration and partnership" between people who share the road.

Still, a battle continues to be waged against the implementation of the Bike Plan. Mary Miles, the attorney responsible for securing the three-year Bike Plan injunction (see "Stationary biking," 5/16/07), momentarily ruined the party at the SFMTA hearing by showing up, casting an icy glare, and warning the SFMTA board to "just stop now. We are appealing these actions." In the overflow room on City Hall’s first floor, Miles’ comments elicited hoots of laughter from a crowd of cyclists.

Miles’ client, Rob Anderson, is known for his cynical view that most people will never be encouraged to ride a bike, and that the Bike Plan unfairly rewards cyclists, a "special interest" group, at the expense of the majority of people, who drive.

Anderson and Miles are expected to appeal the SFMTA’s decision, possibly throwing one last monkey wrench into the process of moving the Bike Plan forward. Construction of new bike lanes can’t begin until the legal issues are resolved and the injunction is lifted.

PARK(ING) IT


A frantic driver who has just found a parking space might be thrilled to seize it, but Matthew Passmore has sparked a different sort of appreciation for parking spaces. One of the founders of Park(ing) Day, Passmore helped draw international interest in 2005 by temporarily transforming a parking space in the Mission District into a public park.

Since then the trend has caught on all over the world: all it takes is some Astroturf, a couch, and a few coins to pay the meter fare — and suddenly the public space usually reserved for cars is transformed into an attractive mini-park for pedestrians and passers-by.

The Park(ing) Day exercise, an event that takes place in September, has since prompted the creation of some 600 parks, free clinics, and other temporary "spaces" as part of the wider commentary about the allocation of public space. In Passmore’s view, "far too much of our city is dedicated to the automobile," and Park(ing) Day is just one way of illustrating this point.

For the soon-to-be 79 miles of bike lanes in the city, after all, there are still 880 lane miles built for cars, and San Francisco streets still accommodate a whopping 320,000 parking spaces. For his part, Passmore characterizes the removal of a few parking spaces as mere "growing pains," but emphasizes that in the long run, the Bike Plan will benefit everyone — not just cyclists.

The nativists are restless

The comments sections of the Guardian‘s Politics blog and the San Francisco Chronicle‘s SFGate Web site have been lit up over the past week with angry (and sometimes overtly racist) denunciations of Latino immigrants, triggered by the latest Chronicle stories challenging San Francisco’s Sanctuary City policies and by Guardian revelations that Chronicle writer Jaxon Van Derkeken accepted an award and substantial cash payment from a controversial nativist group.

While Van Derbeken, two Chronicle editors interviewed by the Guardian, and other critics of San Francisco’s longstanding policy of not notifying federal authorities about the arrests of undocumented immigrants have denied trying to stir up nativist furor, the tone and content of many of these comments seems to indicate they’ve done exactly that.

The saga began June 19 when we published “Chronicle accepts award and cash from anti-immigrant group” on our Politics blog. The story began: “San Francisco Chronicle reporter Jaxon Van Derbeken recently accepted an award and cash prize (he refuses to say how much) from the Center for Immigration Studies — which a Southern Poverty Law Center report in February 2009 criticized for its overtly racist roots and extreme anti-immigrant agenda — for his controversial articles on San Francisco’s Sanctuary City policies.

“CIS paid for Van Derbeken to accept the award at the National Press Club and conservative Chronicle columnist Debra Saunders to introduce him earlier this month, an appearance they used to make derogatory comments about San Francisco, its values, and local immigrant rights activists, while saying little to rebuke the group for stirring up hateful nativist furor around what has become perhaps the country’s most divisive issue.”

Van Derbeken would only address the issue by e-mail, sending us two terse replies to our inquiry and refusing to answer most of our questions, including much how cash he received for a prize that we discovered paid $1,000 in 2001 (the complete e-mail exchange is include in our post).

“No one should mistake their decision to endorse my work for my endorsement of theirs,” was Van Derbeken’s most substantive comment, although he refused to offer an opinion on CIS or the SPLC report, which he didn’t read until after accepting the award. “I haven’t drawn any conclusions about it.”

CIS executive director Mark Krikorian, author of The New Case Against Immigration, Both Legal and Illegal (2008, Sentinel), responded to our inquires with an e-mail blaming the “jihad against dissent from the elite consensus for open borders” and referring to a column he wrote for National Review Online criticizing SPLC’s fundraising.

But in the past, Krikorian has called for the federal government to cut off funding to San Francisco and even prosecute local elected officials, writing in his CIS blog, “Local neutrality on immigration is no longer possible. Every jurisdiction in the country has a choice to make: Either buttress federal efforts at immigration control or subvert them. San Francisco has chosen the second option. It should now learn the consequences.”

We did phone interviews with Van Derbeken’s editors, Managing Editor Steve Proctor and Assistant Managing Editor Ken Conner, who both defended the stories and the decision to accept the award. Neither would reveal how much cash was involved, and neither would admit that it represented validating a group that recently has been vying for mainstream legitimacy.

“All issues have proponents and opponents,” Proctor told us, equating the award to those given for education and legal affairs reporting and denying that the immigration issue is more divisive and controversial. “At the end of the day, it isn’t about this group but about Jaxon’s stories,” Conner told us.

Those stories continued in high-profile fashion a few days later as Van Derbeken essentially rewrote a June 21 Los Angeles Times scoop about how San Francisco District Attorney Kamala Harris allowed a half-dozen undocumented immigrants to enroll in a rehabilitation program rather than turning them over to the feds. The details became front-page lead news stories in the Chronicle on June 22 and 23.

Local immigrant rights activists criticized the Chronicle stories and the paper’s decision to accept the CIS award and money.

“When I read these kind of stories that lead us down a dark path and play on people’s fears and paint immigrants with a broad brush — as a threat, as criminals, as dangerous to the community — I do think that there are anti-immigrant nativist centers egging on reporters like Jaxon down this dark path by giving him cash awards,” Phil Hwang, a staff attorney for the Lawyers Committee for Civil Rights, told us. “It’s part of the strategy these anti-immigrant groups are employing. It’s why they created this award. And if you look at who founded CIS and their vision, it’s clear that they believe America is under threat from non-white immigrants,”

Angela Chan of the Asian Law Caucus, whom Van Derbeken mentioned by name in his CIS award speech, said she is worried this latest round would weaken Harris’ support for Sanctuary City policies. That’s what happened to Mayor Gavin Newsom last fall, when Van Derbeken wrote the stories CIS honored.

“I’d hate to see another series of anti-immigrant scapegoating being used to make hasty policy decisions that violate the rights of immigrants, tear apart families, and increase the state of terror in immigrant communities,” Chan told us.

Harris, who is running for state attorney general, defended her decision to let undocumented immigrants complete the Back on Track program after their presence was brought to her attention, but has since changed the policy to bar them from enrolling. “No innovative initiative will ever be created without some unanticipated flaws to be fixed along the way, but this must not stop us from tackling tough problems with smart solutions,” she said in a prepared statement.

“These are tough economic times,” Hwang added. “People are very nervous about their jobs. And that is often when the [anti-immigrant] rhetoric ramps up.”

The Chronicle writer and editors and Krikorian stopped responding to Guardian inquiries. But the blogs were lit up with comments — hundreds of them from around the country at the bottom of Van Derbeken’s latest stories — that had some disturbing themes, accusations, and suggestions. They indicate that the radical nativists are using this issue — and the Chron‘s spin on it — to promote a dangerous agenda.

Here’s a small sampling:

<\!s> “What is this sham that diversity is great? It is tearing this country apart.”

Such sentiments — which we usually counter on the Guardian Politics blog — were met with silence by Van Derbeken.

San Francisco has been a "transit-first" city since 1973, when the Board of Supervisors first adopted the policy of officially promoting public transit, pedestrians, and bicycles over the automobile. But the label has really been in name only — until this year.

Through an unusual confluence of policy initiatives that have been moving forward for several years, San Francisco is finally about to have a serious discussion about the automobile and its impacts. And parking policies are being used as the main tool to reduce traffic congestion, better set development impact fees, increase city revenue, and promote alternatives to the automobile.

"Our parking requirements need to be revised to support this [transit-first] policy by limiting parking supply — the single greatest incentive to drive — where transit and other modes are viable alternatives," reads the city’s Better Neighborhoods Plan.

While the very notion of deliberately limiting parking will likely be met with howls of protest by many drivers — indeed, urban planners already acknowledge that it’s probably not politically feasible to make drivers pay for their full impacts — they also say it’s the only way to decrease the over-dependence on the automobile.

"Without limiting parking, people will choose an auto-oriented lifestyle and continue to drive. Traffic will continue to worsen, and we will never shift the balance in favor of ways of getting around that are more effective in moving people," the plan continues.

Yet the push isn’t as dire for drivers as its stark language suggests, thanks to some innovative initiatives that could ironically make it even easier to park in some areas than it is now, in the process easing traffic congestion by eliminating the number of cars circling the block looking for parking spaces, which studies show can often account for up to one-third of the cars on the road.

DEMAND-BASED PARKING PRICES


The SF Park program is scheduled to begin later this summer in eight pilot areas, providing real-time parking data to give drivers better information on where to find spots and controlling demand with a market-based pricing system that raises rates when spots are scarce, encouraging turnover and freeing up spaces.

It is just one of many current initiatives. The city is looking at extending meter hours to nights and Sundays and adding parking meters in Golden Gate Park (those are simply revenue measures aimed at city budget deficits). Another study is examining the nexus between parking and developer impacts that could be used to charge new fees for construction. There’s also a comprehensive study of on-street parking policies that will be going before the Board of Supervisors (sitting as the San Francisco County Transportation Authority) next month after nearly five years in the works.

Yet creating more progressive parking policies requires political will, which will surely be tested in the coming months. Indeed, this year’s battle over the Municipal Transportation Authority budget — whose $128 million deficit was closed by Muni fare increases and services cuts rather than parking increases by a ratio of about 4-1, thanks to pressure from drivers and Mayor Gavin Newsom — was an early indicator of the pitfalls that exist within the politics of parking.

Using a $20 million federal traffic congestion management grant, SFMTA has spent years developing the SF Park program, approving most of the details last fall and planning to roll it out by summer’s end.

"Under-regulated on-street parking results in limited parking availability, inefficient utilization of spaces, and excess vehicular circulation," begins the San Francisco On-Street Parking Management and Pricing Study Final Report, which is headed to the Board of Supervisors next month. "This program will assess the effectiveness of using pricing and complementary strategies as a way to manage demand for parking."

The program will be rolled out in eight areas, coordinating parking information in more than 6,000 street spaces and 20 city-owned parking garages, and using that information to adjust parking rates — charging more when spots are scarce and for additional hours — to try to achieve a parking occupancy rate of about 85 percent.

"An on-street parking occupancy of 85 percent has been demonstrated by parking experts … as the benchmark for the practical capacity of on-street parking. At 85 percent occupancy, approximately one available space is expected per block, thus limiting the cruising phenomenon and generally assuring the availability of a space," the study reads.

SFMTA spokesperson Judson True called SF Park "the future of parking management, adding that "we are taking a big bite of the parking management pie with SF Park, which is the most advanced parking management system of any U.S. city."

THE TRUE COST OF CARS


It’s just the latest work product from transportation planners that have spent years behind-the-scenes developing programs to deal with the city’s over-reliance on the automobiles. "It’s all part of a strategy of using parking as a demand management strategy," said Zabe Bent, a planner with the San Francisco County Transportation Authority.

She is working on the parking policies, as well as a proposal to charge motorists a congestion fee for driving into the downtown, which comes before the Board of Supervisors this fall (although implementation is probably at least three years away).

Bent said city officials are working on a number of fronts to shore up San Francisco’s "transit-first" status and prepare for growth in what is already one of the country’s most congested cities. So some of the decisions coming up are bound to be tough.

"It’s a tradeoff we need to make to achieve our goals," she said, noting that the central question transportation planners are wrestling with is, "How do we achieve a more sustainable growth pattern?"

Such noble intentions can always get hung up on politics, and the ever-present question of how to pay for it during an era of fiscal crisis. So it appears the city may have to get creative with funding its new approach to parking.

Alica John-Baptiste, the assistant planning director overseeing the parking impact fee study, said that while it does appear to be a big year for new parking policies, "this conversation has been underway for a number of years. A lot of the discussions we’ve had are now being studied."

Most recently it was the citizens committee that developed the Market-Octavia Plan — one of the first to cap how much parking developers may build along with the projects — that sought guidance about what the city could legally do to recover the full costs associated with automobiles.

"There were a bunch of questions that came up about parking as an issue," she said of the Market-Octavia process. So the Planning Department and other city agencies began to explore the cost of parking as part of the city’s update of the Transit Impact Fee that is charged to new development, with the idea of expanding that to include impacts to all modes of transportation.

"We are looking at parking as a land use and its impact to the [transportation] system," she continued. "This is a city that really wants to support other modes than just transit."

The contract for that parking nexus study was awarded to Cambridge Systematics earlier this month with initial recommendations expected by the end of the year. That study is expected to show that developers and drivers don’t come anywhere near paying for the full cost of the automobile to San Francisco. "These nexus studies usually suggest a much higher fee rate than is feasible to provide," she said.

In other words, drivers and developers would freak out if asked to pay for their full impacts, arguing that that doing so would stifle development, hurt the economy, punish those who need cars, etc. So the fees will likely be set lower than needed to cover the city’s costs.

Even in the short-term, simply extending meter hours into the evenings — as SFMTA is now studying to help the city deal with its budget deficit — is likely to trigger a pitched battle between progressive supervisors and politicians who side with some merchant groups that consider parking sacrosanct.
David Heller, president of the Greater Geary Merchants Association, will be one of those leading the charge. By way of argument, he criticized San Francisco as "a very business-unfriendly city" compared to competitors like Colma and Burlingame and laid out this scenario: "After 6 p.m., there are no power lunches going on. People want to relax. Imagine you sit down to a nice dinner. You’ve got your wine and are enjoying your appetizer and in the middle of your meal, you have to get up and feed the meter. When you return, the ambiance has been lost. What are the chances you’ll return to that restaurant?"
And so it goes with the politics of parking, where pressing realities clash with visceral reactions, driver prerogatives (such as the "right" to feed the meter, which actually isn’t legal), and other distracting entitlement issues.

The mobility of space

Jason Henderson is standing on Patricia’s Green in Hayes Valley, shielding his eyes from the midsummer sun, as he explains how this area, which once lay in the shadowy underbelly of the Central Freeway, was reclaimed as a pedestrian-friendly park.

"In 1989 the freeway went all the way to Turk Street," said Henderson, an assistant professor of geography at San Francisco State University, describing how the raised concrete roadbed, built in the 1950s, cut across this neighborhood and blocked the sky — until the Loma Prieta earthquake hit and damaged the final section so badly it had to be torn down.

That natural disaster triggered a public discussion about the use of the surrounding space, and a 15-year fight that culminated in 2005 in the dedication of the Green, which is part of the Octavia Boulevard Project. Neighbors and business owners pushed the city to convert a damaged freeway into a landscaped park.

That sort of change fascinates Henderson. "I am interested in how people move around cities, and how urban space is configured for movement," he said.

The young professor was raised in New Orleans and wrote his dissertation on transportation and land use debates in Atlanta — which, as Henderson notes, is "the poster child for sprawl but became a hotbed in the ’90s of a national discourse about how we should grow, which became this very interesting debate about reurbanizing."

Henderson’s research focuses on the politics of mobility. He decided to move to San Francisco in 2003 because he saw it as an opportunity to live in a city where a car is not necessary and to study the history of the city’s freeway revolt, which began in the 1960s.

And while he is proud of this park, which was dedicated as Hayes Green then renamed for the late Patricia Walkup, a Hayes Valley resident who tirelessly advocated for the park until her death in 2006, Henderson thinks the local politics of parking have reached "a spatial stalemate."

"During the freeway revolt of the 1960s, San Francisco rejected the freeway but not the automobile," Henderson explained. "But even as San Francisco residents decided that they did not want big gashes of freeway through their waterfront, the Marina, and Golden Gate Park, the city continued to have laws that said every housing unit was to have one parking space.

"So the city adopted a transit-first policy on paper, but didn’t take space away from cars. And if you don’t do anything, you’re not solving the problem."

The problem in San Francisco is what he called the "essentializing of cars."

"A core idea within the parking debate is that there is a universal love affair with the automobile," Henderson explained. "But Obama is downsizing GM and Chrysler, and for the first time since 1960, vehicle miles traveled have started to go down. Until last year, the mantra was that Americans are going to drive. But then we found out that at $4 a gallon, this country freaks out and changes."

Earlier this year, Henderson published a paper that analyzes the city’s politics of parking through the lens of two ballot initiatives from the November 2007 San Francisco election.

"San Francisco’s parking debate is not just about parking. It is a contest over how the city should be configured and organized, and for whom," Henderson wrote in his paper, titled "The Spaces of Parking: Mapping the Politics of Mobility in San Francisco."

His research led him to conclude that progressives, who want to make the city more bike- and public-transportion friendly, are pitted against the more conservative elements (he calls them neoconservatives), who want to increase space for parking and cars at all costs, with the moderate (or in his words, "neoliberal") factions tangled in between.

Part of Henderson’s critique involves estimating the hidden costs of parking — and as it turns out, that can be done using Google and Craiglist. According to a San Francisco Municipal Transportation Agency 2008 fact sheet, there are an estimated 320,000 on-street parking spaces in San Francisco, including metered spaces, each consuming, on average, about 160 square feet.

According to a 2002 presentation by Jeffery Tumlin, a national transportation consultant, if the city rented these spaces for the lowball rate of $1,000 a year, San Francisco would rake in $320 million annually.

There would be no shortage of demand — market prices are way higher. Henderson’s review of Craiglist unearthed folks who looking to rent parking spaces in San Francisco and willing to pay from $100 to $500 a month.

But SFMTA — which issues more than 89,000 residential parking permits annually and recently opted to cut Muni service and routes and increase fares on public transit rather than extend parking meter hours to balance its budget shortfall — decided to increase the cost of these parking permits, starting July 1, by only $2, from $72 to $74 — per year. That’s less than 10 percent of market value.

The resulting revenue will be dedicated to the cost of administrating the program — not to offset the hidden costs of parking, which include carbon dioxide emissions, air pollution, congestion, and occupying valuable space.

Henderson is intrigued by the relationship between parking policy and a complex set of factors that include public health, obesity, and the cost of affordable housing. He notes that if a city’s housing policy requires developers to provide a parking space for each housing unit, too often developers don’t build that housing, or build it smaller, or build it as part of a luxury complex.

"The progressive response to this dilemma is to try to get government to eliminate the one parking-space-per-unit goal and cap the total amount of parking built. Meanwhile, the neocons, who believe government should be active in creating more parking, rail against more bus lanes," Henderson said.

As he notes, common to both groups is the desire for government to help them achieve their vision.

"Much as we see San Francisco as a progressive place, it’s also peopled by neoliberals and very conservative folks — and progressive and neoliberals coalesce on the issue of ‘smart growth.’ And there are lot of progressives who have a car and say, ‘I don’t want to be car dependent; I’d like to do city share, but I’d feel stranded.’ And those who say ‘I always want to have my own car, but I only drive it once a month.’"

Conceding that "tweaking the system" will cost money, Henderson cites congestion pricing as an area where the various factions can find agreement.

"The important question is, what will the revenue be used for?" Henderson said, noting that some will argue that if you charge motorists to use roads, then the money should be used to improve the roads, which is what has happened with toll roads in Texas.

But in San Francisco, activist are pushing the opposite approach. "Whereas the sustainable transportation movement in San Francisco wants to use the revenue from congestion pricing to fix Muni and discourage driving," he continued.

In his paper on parking policy, Henderson details exactly how parking allocations push up the price of housing — and change the face of ongoing developments.

A typical off-road parking space takes up 350 square feet when room to move in and out is factored in — and that’s comparable to many offices and living spaces in San Francisco. The parking alone costs $50,000 to $100,000 to develop — a cost that’s passed on to the homebuyer.

But in most neighborhoods, developers can’t avoid parking, because of planning laws. "This means that neighborhoods like the iconic North Beach simply could not be built today," Henderson wrote, noting how mandatory parking provisions mean that the lower floors of new buildings are likely to contain parking garages, not storefronts and cafes, and garage entrances take away street parking and limit where street trees can be planted.

"But at least contesting car space is on the table in San Francisco" Henderson said. "That makes it an intriguing bellwether for other places."

Bending toward oblivion

Gay liberation changed Martin Duberman’s life. In the 1960s, Duberman taught history at Princeton, hardly a bastion of radical thought. Yet he found himself invigorated by nascent counterculture movements and became a champion of the left, penning essays in The New York Times and serving as faculty advisor to the Princeton chapter of Students for a Democratic Society. At the same time, Duberman spent years in intensive psychotherapy in desperate attempts to "cure" his homosexuality. Soon after the emergence of the gay liberation movement, however, he rejected this homophobic vision and embraced a gay identity. His work also became queerer.

Over the years, he has written more than 20 books — biographies, plays, memoirs, history texts, and a novel — on a wide range of topics ranging from antislavery activism to the civil rights movement and Stonewall. His new book, Waiting to Land: A (Mostly) Political Memoir, 1985-2008 (The New Press 352 pages, $26.95), is a combination of diary entries and recollections from the Reagan years to the present. This latest work serves as a window into Duberman’s activist and scholarly careers, as well as his critiques of the mainstreaming of the gay and lesbian movement.

SFBG We’re approaching the 40th anniversary of the Stonewall riots, the symbolic event of early gay liberation, and I’m wondering if you think there’s any of this liberationist spirit left in the gay movement.

Martin Duberman Well, I guess it depends on how you define liberationist. In the early days, gay liberationists were aware of a great many other ills in the society besides their own. Their own were real, and they were well aware of that. But there was a lot wrong, they felt, with the system, and their central goal was to challenge many of the established institutions and values. Today most LGBT people seem to think of themselves — certainly they tell the mainstream — as "just folks," except for this little matter of a separate sexual orientation. That they’re patriotic Americans and they want the same things that everybody else wants, etc.

SFBG In Waiting to Land, you cover this assimilationist turn in the gay movement. You talk about the March on Washington in 1993 where gays in the military became the dominant issue. You also talk about Stonewall 25, which happened one year later in New York City, where one of the biggest fundraising events was held onboard a U.S. aircraft carrier, and where corporate sponsorship arguably overwhelmed any celebration of resistance, history, or culture. Has anything changed in the last 15 years?

MD The early ’70s were still fueled by the countercultural movement of the ’60s, and the early gay movement built on the insights and the demands of, say, the feminist movement or the antiwar movement. I mean there was so much going on in the ’60s, and together it all amounted to a challenge to the so-called experts. There was an across-the-board challenging of many traditional views, so finally that began to seep down, or up — whatever it is — to us. That’s the whole trouble, I think, with the assimilationist turn. It denies our own gay past and our culture and our politics. I mean, they’re willing to throw all that away in order to make stronger the claim that we’re just folks.

SFBG And do you feel like mainstream gay people have become more heterosexualized? I mean in that particular way of embracing long-term committed partnership, monogamy, or now even marriage, as the only type of love or intimacy that’s valid?

MD Yeah. Once again, the banner of lifetime monogamous pair-bonding has been raised. Now some of that is the result of AIDS, in which people were scared to death, so they settled down into so-called permanent relationships. Not everybody. But many more than had done so in the ’70s.

SFBG When you talk about AIDS in Waiting to Land, it punctures the style of your writing. You’ll be writing something that’s more ruminative, and then you’ll have three or four sentences about a friend who died or a series of friends who died, and then you go back into your thoughts about something outside of that.

MD I think that’s right. It’s why I put that subtitle in. I say "mostly political," because when it came to the death of friends, I did talk about my personal feelings, and my sadness, whereas most of the time in Waiting to Land I’m talking about external events or public policies.

SFBG You yourself have played a role as both an insider and outsider in a variety of realms. In Waiting to Land, you deliver scathing critiques of the rigid hierarchies and competitive structures of academia. You talk about the homophobia of the straight left, and you talk about the limited agenda of the gay mainstream. You talk about the exclusiveness of establishment theatre and mainstream media. Yet you’ve also worked inside all these structures. So I’m wondering how these institutions have formed your politics and how you’ve helped to form or transform these institutions.

MD [W.E.B.] Du Bois, the great African American leader, once said something — I think he called it double vision. He said that although he had had a superb education and was accepted by mainstream whites, nonetheless he felt he was a spy in the culture, a spy who was bringing the news about the mainstream back to his own people. And on one level, I have had a very easy time passing — I went to very good schools, I was on the tennis team in high school, etc. Nobody, I think, or very few people, guessed that I was in fact homosexual, and I did my best to play along with that. I was very career-oriented, I was very competitive — I always wanted to be first in my class, win the best prize for an essay, and that’s where most of my energy went throughout my 20s. But then once the counterculture began, I sort of leapt on it. I was immediately sympathetic, and I wrote lots of essays during the ’60s in which I was very strongly on the side of the New Left. And then it took a while longer after that before I realized that of course the same applies to being gay.

SFBG In terms of your role as both insider and outsider, do you feel that that’s helped you to develop stronger critiques of all those institutions, whether on the straight left, in the gay mainstream, or in establishment theater and media?

MD I think so, because I knew the inner workings of many of these mainstream institutions, and so I was able to see the falsity of many of the attitudes, especially toward people who are not middle-class whites. White men, I should say.

SFBG I think one thing you’ve tried very deliberately throughout your career, whether as a writer, an academic, or an activist, is to build movement ties across lines of class, race, gender, and age. In the new book, you talk about trying to bring an awareness of queer and feminist issues into the straight left, and an awareness of race and class into the gay mainstream — and feeling mostly like you’ve failed.

MD I think it’s because the mainstream left is no more receptive — they all claim that, "well of course we believe you people should have your rights, and of course we’re tolerant of your lifestyle." But when it comes right down to it, you cannot get them to hang around long enough to listen to the ways in which queer values and perspectives might inform their own lives. They don’t believe that for a second. And that hasn’t changed at all. At least, if it has changed, I haven’t seen it.

SFBG And what about in terms of the other side of the equation? With the dominant agendas of the big gay institutions centering on marriage, military service, ordination into the priesthood, adoption, and unquestioning gentrification and consumerism, do you think that those particular emphases prevent a deeper analysis of structural issues of racism and classism?

MD Well, of course they do. Mainstream America is still further behind the gay movement in dealing with any of those issues. So when you’re bending your energy to turning into the mainstream, you’re simultaneously burying your awareness of the class and racial and economic divisions that continue to characterize our country.

The dueling budget rallies that preceded the June 16 Board of Supervisors hearing on the city’s spending priorities officially ended the conciliatory approach offered by Mayor Gavin Newsom — a rhetorical political gambit that the Mayor’s Office never really put into practice.

The emotionally charged police and fire workers’ rally — where Police Officers Association President Gary Delagnes riled up the crowd by ridiculing supervisors as "idiots" and "carpetbaggers" — featured Newsom as the guest of honor at an event overseen by Eric Jaye, the political consultant running both the firefighters’ union budget offensive and Newsom’s gubernatorial campaign.

On a stage lined with American flags and burly public safety workers, Newsom condemned the progressive supervisor’s proposal to amend his budget over a blaring sound system. "They’re asking us to retreat," Newsom said, in full battle cry mode, "and we’re not going to do that."

Across the street, city employees from the Department of Public Health held a competing rally, flying a banner that read "No Cuts to Vital Services!" It was painfully obvious that in a squabble between city employees, the mayor was positioning himself on the side of well-paid, powerful union members who got raises instead of layoffs, rather than the public health workers and advocates for the poor whom Newsom’s budget cut the deepest.

But before progressive supervisors challenged Newsom’s proposed budget — which ignored the supervisors’ stated priorities, despite Newsom’s December pledge to work closely with the board on it — the rhetoric was quite different. "We work through our differences and ultimately try to look at the budget as apolitically as possible," Newsom said during a June 1 event unveiling his budget. "It’ll only happen by working together."

Six months earlier, when the mayor made a rare appearance at a Board of Supervisors meeting to announce the unprecedented budget shortfall of more than $500 million, he adopted a similar tone. "We have the capacity, the ingenuity and the spirit to solve this," Newsom told the board in December. "It’s going to take all of us working together. It’s in that spirit that I am here."

The mayor’s proposed budget has spurred outrage from poor people and progressive supervisors, who charge that his decision to cut critical services while simultaneously bolstering funding to the police and fire departments is morally repugnant.

Sups. John Avalos, David Campos, and David Chiu responded by passing an amendment in committee to slash $82 million from the public-safety budget in order to restore some of the cuts to public health and social services. After that move, the spirit of "working together" quickly eroded, and seemed to be replaced by the bare knuckles politics of fear and division.

After the rallies, which even spilled indoors and devolved into shouting matches between the two camps, supervisors finally got to work on the budget. And they didn’t ask Newsom to retreat, they just asked him to listen and work with them.

The $82 million dent in the public-safety budget was described as a symbolic gesture to get the mayor to take progressive concerns seriously. "For many of us, it was the only way we felt we could have a seat at the table — a seat that was real, where the discussion was going to be meaningful," Campos said.

"I do not think that this budget is bilateral. It is a unilateral budget," Chiu noted at a Budget and Finance Committee meeting.

This year’s budget battle is especially intense because of the unprecedented size of the deficit, as well as the dire economic conditions facing many San Franciscans. California’s unemployment rate climbed to 11.5 percent in May, and stood at an only slightly less miserable 9.1 percent in San Francisco, according to the state’s Employment Development Department.

Meanwhile, anecdotal evidence suggests that the number of San Franciscans in need of emergency food assistance, homeless services, and help with other basic necessities has spiked. Everyone seems to be feeling the pinch, but for the least fortunate, falling on hard times can mean relying on city-funded services for survival.

Against this dismal backdrop, big questions are emerging about the role of government. "The city’s budget," City Attorney Dennis Herrera noted at a recent hearing, "is correctly called the city’s most meaningful policy document. More than any other piece of legislation, it sets out the priorities that tangibly express the values of the City and County of San Francisco."

Sup. Ross Mirkarimi took this idea even farther at the budget hearing. "Aside from the politicking and any of the hyperbole, we [have to] do the best we possibly can for all the people of San Francisco," he said. "But in particular, the vulnerable classes, because what is also at stake is … the key question: Who’s this city for? And who gets to live here over the next 10 to 20 years, considering how cost-prohibitive it is to be in San Francisco?"

The budget battle is shaping up around some fundamental questions: is this budget going to protect the politically powerful while ignoring the thousands who are in danger of slipping through the cracks? Or will everyone be asked to make sacrifices to preserve the city’s safety net? And as these difficult decisions are hashed out, is the mayor going to sit down with the board to seek common ground?

A board hearing on the cuts to health services — which state law requires cities to hold when those cuts are deep — illustrated the divide with hours of testimony from the city’s most disadvantaged residents: those with mental health problems, seniors, SRO tenants, AIDS patients, and others.

"If we make the wrong decisions, it will mean that our homeless folks will be in ever-increasing numbers on the street. It means that folks with HIV will not receive the care they need. It will mean that kids will not have the after-school programs they need during their critical years. It will mean that our tenants will continue to live in substandard housing," Chiu summarized the testimony.

Avalos, the Budget Committee chair who has led the fight to alter Newsom’s budget priorities, has said repeatedly that cutting critical services does not work in San Francisco. And even as he proposed the amendment, he expressed a desire to reach a solution that everyone, not just progressives, would find palatable.

"We want to talk directly to the mayor, to have him meet us half-way, about how we can share the pain in this budget to ensure that we have a balance in equity on how we run the city government," Avalos noted as his committee began its detailed, tedious work on the budget. "We can do that across the hall here at City Hall, and we can do it across every district in San Francisco."

The Board approved the interim budget that more evenly shared the budget pain on a 7-3 vote, with Sups. Bevan Dufty, Carmen Chu, and Michela Alioto-Pier dissenting (Sup. Sean Elsbernd was absent because his wife was giving birth to their first child, but was also likely to dissent).

If Newsom chooses to veto the interim budget or the permanent one next month — which the board would need eight votes to override — San Francisco could be in for a protracted budget standoff, the least "apolitical" of all options. But for now, the political theater is yielding to the detailed, difficult work of the Budget and Finance Committee.

Progressive members of the committee have already signaled their intention to scrutinize city jobs with salaries of $100,000 or positions in each department that deal with public relations.

Among those highlighted in a budget analysts’ report is Newsom’s public relations team, a fleet of five helmed by a Director of Communications Nate Ballard, who pulls down $141,700 a year. Yet when the Guardian and others seek information from the office — for this story and many others — we are often stonewalled, ignored, or insulted.

During the budget hearings, the disproportionately high number of positions with six-figure salaries in the city’s police and fire departments also came under scrutiny. "What has worked in a lot of other agencies is you have employees who care deeply enough about the City and County of San Francisco that they are willing to give back in terms of salaries," Campos commented to Fire Chief Joanne Hayes-White during a budget hearing, referring to firefighters’ refusal to forgo raises.

Another looming question is whether new revenue measures will be included as part of the solution. While progressive supervisors continue to call for tax measures as a way to stave off the worst cuts to critical services, Newsom proudly proclaimed his budget’s lack of new taxes.

A press release posted on Newsom’s gubernatorial campaign Web site suggests that since raising revenues doesn’t fit with his bid for governor, it’s not likely to be entertained as a possibility. "Mayor Newsom crafted a balanced budget on time," a press release notes, "without any new general tax increases, without reducing public safety services."

It’s a stand that’s certain to yield more political clashes down the line.

"I don’t see how we can get out of this budget without bringing additional revenue into the system," Campos noted at the committee hearing. "Once people learn about the situation we are facing, they will understand the need for the city and county as a whole to contribute."

The price of normal

With a 2010 state proposition on gay marriage in the works and a national gay rally on the Washington Mall being planned for October 10-11 of that year, it’s obvious that more and more of the LGBT community’s resources are being funneled into the battle for marriage equality, while other causes go begging.

Already gay marriage has become a black hole that is sucking untold amounts of money, time, and energy out of our community. In the 2008 election alone, gay marriage supporters raised $43.3 million to defeat Proposition 8, the anti-gay marriage initiative that California voters passed by 52 percent. It may be the biggest chunk of change the community has ever spent for a single fight.

A QUESTION OF PRIORITIES


I’m not against gay marriage. If queer couples want to be as miserable as straight ones, that’s their choice. Marriage is a failed institution. With a 54.8 percent divorce rate nationally and a 60 percent rate here in California, there’s no doubt in my mind that heterosexual "wedded bliss" is more of an oxymoron than a reality.

What’s troubling to me as a queer activist of almost 40 years (much of that time spent on economic justice work) is that, with the tremendous amount of homelessness, poverty, and unemployment in our community, we are spending so much dough on the fight to give a minority of folks — those who opt for tying the knot — rights and privileges that straight married folks have.

Sure, it’s unfair that married straights get tax breaks, not to mention the status of next-of-kin for hospital visits and medical decisions when one partner is ill, and queers don’t. Altogether, married couples have 1,400 benefits, both state and federal, that domestic partners and single people don’t enjoy. It’s a matter of simple justice that the playing field be leveled. Only a right-wing idiot could disagree with that. Now, if only we could fight to give everyone (including singles) those 1,400 benefits.

For me it’s a question of priorities. We are living in scary times. Unemployment is sky-high; millions are without healthcare, including children; foreclosures are robbing homeowners and tenants alike of their housing; and business collapses are leaving a lot of people out in the cold and unable to pay the rent or the mortgage.

DINKS NO MORE


The queer community is no better off.

It’s a popular misconception that queers have a lot of disposable income. The "double income, no kids" (DINK) myth was promoted in the 1980s by gay publishers who wanted to expand their advertising base and their profits. These days, to read many gay publications, you’d think that all queers are going on fabulous vacations and buying expensive clothes, jewelry, and electronic gizmos.

That myth was easily dispelled by a recent study, "Poverty in the Lesbian, Gay and Bisexual Community," published this March by the Williams Institute at UCLA. Like "Income Inflation: the myth of affluence among gay, lesbian, and bisexual Americans," the groundbreaking 1998 study by M.V. Lee Badgett of the Department of Economics at the University of Massachusetts at Amherst, the Williams report found that many members of our community aren’t shopping ’til they drop. They can barely afford to put food on the table.

Nationally, 24 percent of lesbians and bisexual women are poor compared to 19 percent of heterosexual women; 15 percent of gay and bisexual men are poor compared to 13 percent of heterosexual men.

Queers aren’t just low on cash — we’re homeless, too. A 2006 report, "Lesbian, Gay, Bisexual and Transgender Youth: An Epidemic of Homelessness" from the National Lesbian and Gay Task Force and the National Coalition on Homelessness, showed that 20 percent to 40 percent of the 1.6 million homeless youth in America identify as LGBT. In San Francisco, the number of queers in the homeless youth population (estimated at 4,000 by the Mayor’s Office) is "roughly 44 percent," according to Dr. Mike Toohey of the Homeless Youth Alliance in the Haight.

Brian Basinger of the AIDS Housing Alliance says that 40 percent of people with HIV/AIDS, in the city once acclaimed for its care of those with the disease, are either "unstably housed or are homeless." In the Castro, Basinger said, there are only "12 dedicated HOPWA beds" for people with the disease. HOPWA (Housing Opportunities for People with AIDS) is a federal voucher program for low-income people with AIDS that is similar to federal housing assistance program Section 8.

Certain members of our community don’t fare much better in the area of employment. A 2006 survey by the Guardian and the Transgender Law Center reported that 75 percent of transgender people are not employed full-time, and 59 percent make less than $15,299 a year. A mere 4 percent of respondents earned more than $61,200, the then-median income average for San Francisco.

Fifty-seven percent of trangendered people said they suffered employment discrimination, demonstrating the need for the inclusion of "gender identity" in the federal Employment Non-discrimination Act. Human Rights Campaign, a national gay organization, and out Congress member Barney Frank (D-Mass.) cut transgenders out of that legislation the last time it was up before Congress.

It could all get a whole lot worse.

AXING THE FUTURE


Gov. Arnold Schwarzenegger wants to lop at least $81 million from California’s AIDS budget, including money for AIDS drugs, leaving low-income people stranded without their medication. Senior services are also on his cutting block, including $230.8 million from in-home services and $117 million from adult health-care programs. (As we go to press, the state Legislature is working to restore the AIDS money to the budget.)

Mayor Gavin Newsom, in his proposed city budget cuts, is axing $128.4 million from public health and $15.9 million from human services. There’s no doubt these cuts in health and human services will severely affect people with AIDS, seniors, youth, the homeless, and others in our community who can least afford to pay for the city’s budget shortfall.

The millions spent on gay marriage in the past few years could have gone a long way in these lean times. It could have helped make the proposed queer senior housing project, Open House, a reality. With 88 units in the works at 55 Laguna St., the site of the old UC extension, it will be the only such housing for LGBT seniors in San Francisco.

The money also could have funded housing in the Castro for homeless queer youth or people with AIDS. It could have been used as seed money for a much-needed war against poverty in the LGBT community.

A DIFFERENT KIND OF LIBERATION


The queer movement hasn’t always been this obsessed about getting hitched. Forty years ago this week, drag queens and others fought back against the cops who were raiding a gay bar called the Stonewall Inn in New York City’s West Village. Three days of protests led to the creation of the Gay Liberation Front (GLF), a revolutionary group dedicated to the sexual liberation of all people. GLFers weren’t looking to walk down the aisle or form binary couples. In a desire to "abolish existing social institutions," as the NYC branch of GLF said in its statement of purpose, some GLFers explored polyamory (more than one relationship at a time).

That’s why I edited Smash the Church, Smash the State! The Early Years of Gay Liberation, just published by City Lights Books, a collection of writings by former GLF members and other gay liberationists. I wanted to commemorate the 40th anniversary of Stonewall and the birth of GLF with a reminder of who we were and what we did. After all these years, I still don’t want to head to the chapel to get married.

When it really comes down to it, gay marriage is a conservative issue. It’s about wanting to fit in, to be like everyone else. Beyond the important issues of tax breaks and next-of-kin status — and the fact that if any institution exists, it shouldn’t discriminate against queers — marriage is ultimately a means of normalizing binary queer relationships, especially for gay men who have always enjoyed the freedom to be promiscuous. It’s a way to try and rein in our libidos, though the prevalence of extramarital sex among straight couples — 50 percent for women, 60 percent for men, according to a recent issue of Journal of Couple and Relationship Therapy — shows that marriage doesn’t come with a chastity belt.

It also doesn’t come with any guarantees, as researchers discovered in Sweden, where queers were able to contract for same-sex partnerships from 1995 until recently, when full same-sex marriage was instituted. According to a study by the Institute for Marriage and Public Policy, Swedish queers have been divorcing in high numbers, like their straight counterparts, who have a divorce rate that’s just a little higher than the United States.

For queers in Sweden, that’s the price of being normal.

San Francisco’s legendary nightlife venues are being threatened by a state agency that over the last two years has adopted a more aggressive policy of enforcing its arcane rules, in the process jeopardizing both needed tax revenue and a vibrant, tolerant culture that these bureaucrats don’t seem to understand.

At issue is an arbitrary policy of the California Department of Alcohol Beverage Control. For the past two years, ABC has been on a campaign against a growing list of well-established clubs, bars, and entertainment venues in the city, an effort driven by vague rules and stretched authority. The community has rallied behind the bars and local politicians have spoken against ABC’s crusade, but the agency isn’t showing any signs of stopping.

Most recently, Revolution Café in the Mission District had to stop selling beer and wine for 20 days after ABC cited them for patrons drinking on the sidewalk adjacent to its front patio. Inner Richmond’s Buckshot’s liquor license was pulled because of technical violations of alcohol and food regulations, forcing owners to close their doors for a few weeks. Both bars stand to lose a substantial portion of their profits before returning to normal business operation.

DNA Lounge’s license is currently being held over its head because ABC saw operators as "running a disorderly house injurious to the public welfare and morals" after sending undercover agents in during queer events. State Sen. Mark Leno responded by telling the Guardian, "The ABC should enforce the law, not make statements relative to morals."

Café du Nord, Slim’s, Swedish Music Hall, Great American Music Hall, Rickshaw Stop, Bottom of the Hill, and a list of more than 10 others are also fighting long, expensive battles to stay open — but not because of underage drinking or drinking-related violence. In fact, most of these venues never had a run-in with ABC until two years ago. These bars’ livelihoods are being threatened because of an arbitrary technicality on their alcohol and food license.

ABC was established in 1957 with the mission to be "responsible for the licensing and regulation of the manufacture, sale, purchase, possession, and transportation of alcoholic beverages." ABC is funded through alcohol license fees, and has been run by governor-appointed director Steve Hardy since 2007, about the same time the crackdown started.

According to ABC spokesperson John Carr, the problem is that these clubs are deviating from their original business plans. The venues are "operating more like clubs, with only incidental food service." ABC didn’t notice any changes in these businesses until two years ago. In some cases, it took ABC 20 years to notice a change.

For example, when Café du Nord owners filled out the forms to get their business license, they were asked to predict the percentage of alcohol sales to food sales. Predictions didn’t pan out exactly, and ABC started an audit two years ago. The only recourse to an audit is to adhere to a random rule that requires these all-ages venues to serve 50 percent food and 50 percent alcohol. This rule is not a law, and ABC isn’t required to enforce it.

Slim’s has been cited on the same food/alcohol grounds. Its sister club, the Great American Music Hall, as well as Bottom of the Hill and most recently Buckshot all have similar 50/50 stories. All are fighting financially drowning battles with ABC. At some point in the court process, these bars must appear in ABC courts with judges hired by Steve Hardy.

Carr claims that only one venue, which he declined to identify, is being cited with the arbitrary 50/50 rule. All the other venues must adhere to their own specific ratio of food to alcohol, written in their original business plans. Regardless of the specific numbers, all are being threatened on the grounds that "they altered the character of their businesses […] which is different from the business plan they submitted to ABC when they were originally pursuing their ABC license."

Many of the bars in question have been around and thriving for decades with the same focus on business, music, and culture. Slim’s, for example, has been in San Francisco for 22 years, going the first 20 without a citation. But in the past two years, it has had four citations between it and the Great American Music Hall.

There is much speculation from all sides of this war about its causes, but no one seems to know why ABC, seemingly out of nowhere, started its crusade against music venues and clubs in San Francisco. Even the ABC is vague and unresponsive about this, broadly claiming it is acting on complaints and just doing its job.

Since the inception of the crackdown is a mystery, it seems fitting to focus on finding a resolution. The last thing anyone in this city wants is to see the clubs and venues shut down, something club operators say hurts the city’s culture. "Kids growing up with live music can only be good," said Dawn Holiday of Slim’s.

Beyond the culture and rich nightlife in question, bars and clubs bring in a significant amount of money to the state. Some of the bars alone can bring the state more than $5,000 each month in sales tax. In the current economic crunch, shutting down reliable sources of revenue doesn’t seem wise.

After two years of battles, ABC has taken some of the bigger hearings off the calendar in an attempt to come to a peaceful resolution. After talks with Hardy, Leno is hopeful for a positive end to the battles. Leno does not want to see any business closed and believes the best way to ensure a thriving nightlife is to establish a special license for the venues. If the only problem with our beloved venues is technicalities with the license, let’s change the license, not the venues.

In the meantime, the community is rallying around the bars and entertainment venues, showing its support. DNA Lounge started asking for donations for its legal proceedings. Maybe the best way to fight back is to go out and have a drink, listen to music, dance with queers, and over-indulge in unadulterated San Francisco culture.

Wexler’s opened Friday with gourmet ‘Que and Southern flavors in a former firehouse
The former Les Amis has been dramatically redone into Wexler’s, a space that reminds me of hip European bistros: lots of white, wood, clean line minimalism, warmed by 15 draught beers (of the Allegash and Ommegang kind) and generous wine list. This is "new American BBQ" from chef Charlie Kleinman, of Fish & Farm and Fifth Floor. I went for lunch (priced at $7-12) opening day and enjoyed fresh Monterey Bay Squid Salad with fried green tomato chunks, frisee, pickled Fresno chilies. A 4505 Meats Mission Dog is topped with bacon (there’s the Mission part), chilies and caramelized onions. A straightforward "Sloppy Joe" on an Acme roll was probably my initial favorite, the tender Texas-style burnt ends packing rich flavor. They were out of both desserts I wanted on opening day (the one I tried didn’t excite), but they’re certainly working out the usual opening kinks and I can’t wait to come back and try Sour Cream Japanese Pear Pie and Inside-Out Root Beer Float (house-made vanilla soda with Humphry Slocumbe root beer ice cream – yes!) Dinner ($9-23) equally intrigues with Smoked Maine Lobster, BBQ Scotch Eggs, Wexler’s Plate of Pork, and Hush Puppies. A balanced selection of fine bourbons, brandies, and other spirits make ideal pairings with smoky eats. Even cooler than the rib-like ceiling and red chandeliers is the (virtually) guilt-free combo of BBQ that’s local, sustainable and made with care.

Sakoon debuts upscale Indian restaurant in Mountain View this week
It’s a drive down from the city to be sure, but with few upscale Indian dining options in SF, it’s nice to know brand new Sakoon (meaning peace), is not too far away. In a large, 6000-square foot former bank, there’s a mezzanine, fiber-optic chandeliers, Buddha in hand-carved wooden panels, and, yes, a waterfall rushing into pool dotted with lotus petals. Exec Chef, Sachin Chopra, formerly of Palo Alto’s Mantra, put together a menu of Indian food with contemporary touches well beyond the defined Northern or Southern Indian cuisine categories, with most entrees priced under $20, like Malabari Seabass, pan-seared with aloo tikki, pindi chole, and tamarind essence. The flavors of Kashmir show up in Gushtaba, lamb koftas in roasted onion and yogurt sauce. A five-course Farmer’s Market Tasting Menu (vegetarian: $35; non: $40) provides further taste opportunities, lunch buffets are offered daily, and a Sunday through Thursday happy hour (5-7pm) means $5 cocktails and cheap bar bites. If you’ve seen Flesh (1968) or Trash (1970) or Heat (1972), there’s a good chance you’d like to spend an hour alone with Joe Dallesandro. Let’s face it — that’s probably not going to happen anytime soon, so you may have to settle for something a bit less private. As substitutes go, Little Joe is a nice alternative: no, you can’t talk to (or touch) Dallesandro directly, but the experience is certainly intimate.

Little Joe just isn’t your standard documentary. Forget the talking heads or — horror of all horrors — reenactments. This is Joe on Joe: 90 minutes of the Warhol superstar reflecting on his accidental fame and everything that came after. It’s a fascinating story, even without the cinematic embellishments. Of course, it helps that Dallesandro himself does all the talking. For one thing, he’s undoubtedly the best authority on his life. For another, he’s not bad to look at, even pushing 60.

The film was conceived and produced by Vedra Mehagian Dallesandro, Joe’s daughter, and Nicole Haeusser, who also directed. Speaking about their unusual approach, both agree that the close, conversational style gives a better sense of the subject than other films might be able to do.

“Our original goal was to make a great documentary on Joe, because many have tried,” Vedra Dallesandro explains. “And we’re very intimate and connected to him. That’s the reason he did this for us.”

But, as Haeusser elaborates, the filmmakers’ decision to do the film as a one-on-one with Dallesando wasn’t appealing to potential producers, who sought a more conventional documentary technique.

“When Vedra tried to get financing, they were all worried about the third act,” she says. “They were worried that Joe was still alive and wanted to wait for him to die, basically. So Vedra and I were talking, and I was like, ‘Well, we don’t need money. We can just do it ourselves.'”

The decision turned out to be a happy accident: Little Joe’s biggest strength is its almost amateur quality. Which is not to say that the film feels lacking — it’s just an intentionally limited production. There are no experts over-explaining Dallesandro’s overnight success (he was hot) or later substance abuse (it was readily available). Nor are there any TMZ-esque voiceovers highlighting the more illicit aspects of his career. And who needs ’em? The clips of Dallesandro strutting nude through, well, all of his early films speak for themselves.

Of course, the point of all the real talk with Dallesandro is to show that he’s more than just a sex object — and the message definitely comes across. He is, as he puts it, smarter than people give him credit for.

“A lot of times you hear people talk about him like he’s a piece of meat,” Haeusser says. “And he’s a very spiritual person.”

I don’t know if that’s quite the impression I got, but Little Joe does flesh out Dallesandro (pun fully intended) more than frequent collaborator Paul Morrissey ever did. Dallesandro’s early career was about his appearance: the muscles, the hair, the manparts. And that’s all well and good, but no one wants to be defined solely by how good they look naked. This documentary is the ideal vehicle for Dallesandro to prove, as the saying goes, that he’s more than just a pretty face.

Still, there’s no denying Little Joe‘s eye candy status. To its credit, the film never shies away from that. No one appears embarrassed or regretful about the past, and why should they?

“Who he is, is who he is,” Vedra Dallesandro offers. “I think it’s amazing.” Amazing may sound like a stretch, but consider the life of a sex symbol. It takes courage to bare it all — and it takes star quality to turn that into a career. (Louis Peitzman)

ODE TO JOE: A FIRST-PERSON TESTIMONY TO STARDOM OF DALLESANDRO

“Don’t do this to me and leave me, Joe!” So rasps Sylvia Miles as Joe Dallesandro dutifully pleasures her missionary-style in a scene from Andy Warhol’s Heat (1972). When it comes to mid-coital dirty talk, could any line possibly be more comically terrible? Miles’ character is Sally Todd, a past-prime actress with a Beverly Hills mansion whose “game show money” doesn’t keep her in hairspray. Dallesandro is Joey Davis, an ex-child star terminally on the make in an attempt to revive his marooned career. But really, anyone who enjoys Heat — and I’ll come right out and say it’s my favorite movie, ever — is enjoying the people behind the characters.

A key reward of the Warhol movies that star Joe Dallesandro is that he doesn’t just do it to us and leave us — his signature brand of candid male sexuality, something entirely new in American cinema when it arrived, is still available to us today. “Little Joe” brought before the camera the fantasies that biographers and gossip tattle-tales entertained about James Dean and Marlon Brando, and his naturalism helped pave the way for Robert DeNiro’s and Al Pacino’s brands of Italian-American charisma and machismo, even if he wasn’t theatrically trained. Yes, Dallesandro was usually stoic-to-stony, scarcely reacting to the hijinx of the myriad feminine characters with whom Paul Morrissey and Warhol paired him. But he knew enough to realize that he didn’t have to do much, which is more than most actors learn in a lifetime.

Joe Dallesandro played a key role for me in terms of knowing I was attracted to men, and I can hardly be alone in that experience. When I first saw him, it was only a portion of his body — his sculpted chest and abdomen, tinted a plum color on the cover of the Smiths’ self-titled 1985 debut album. This image was too oblique to be lust at first sight, but still images of Dallesandro from Flesh (1968) in Parker Tyler’s book Underground Film and Stephen Koch’s Warhol cinema survey Stargazer resolved any lingering issues or teenage doubts. The treat in discovering the movies behind these images was that Dallesandro’s unapologetically naked good looks were simply the hook on which Warhol, and especially director Morrissey, hooked a fantastic crew of eccentrics.

Little Joe, Nicole Hauesser’s new feature-length biographical portrait of Dallesandro, has as much in common with That Man: Peter Berlin (2005) as it does the legion of documentaries about Warhol superstars. Like the Berlin movie, it fascinates as a study of an icon of masculine glamour, though Dallesandro isn’t as narcissistic (who could be) or as detached and cerebral. Hauesser skims over the coded symbols of Dallesandro’s physique model days, and I wish she’d had Dallesandro sound off more about dearly-departed costars such as the amazing Andrea Feldman.

But Little Joe‘s story can’t help but be dramatic. Who knew Dallesandro had an ill-fated handsome brother — shades of Catherine Deneuve and Francoise Dorléac — or that the love of his life was Suspiria (1976) star Stefania Casini? Still handsome today, Dallesandro addresses the camera with a directness missing from his Warhol performances, wrestling uncomfortably with his manipulation by Morrissey, and reminiscing with little sentiment about latter-era Warhol films such as Flesh for Frankenstein (1973) and Blood for Dracula (1974), which includes his best and most hilarious performances — as a Marxist servant with a Brooklyn accent in medieval Europe.

“Have you even lived to know what beautiful is?” Lydia (Pat Ast) asks a male stripper jealous of Joe’s good looks during a sunny afternoon scene from Heat. As Joe descends down some stairs for an underwater swim across the length of a pool, she answers her own question: “You’re just a spoiled brat, living the life of Riley.” Watching Joe Dallesandro in Flesh, in Trash (1970), and most of all, in Heat, we’re all spoiled brats living the life of Riley. PG&E attacks consumer choice

A ballot initiative backed by Pacific Gas and Electric Co. could amount to a death sentence for community choice aggregation (CCA) and expanded public power in California.

Dubbed the Taxpayers Right to Vote Act, the proposed initiative would require a two-thirds majority vote at the ballot before any local government could establish a CCA program, use public funding to implement a plan to become a CCA provider, or expand electric service to new territory or new customers.

The new hurdle would make it very difficult for a local government to move forward with a CCA, while at the same time making it much easier for a utility to defeat public power at the ballot.

Signed into state law in 2002, CCA allows local governments to buy up blocks of power to sell to residents, making it possible for cities and counties to set up alternatives to private utilities such as PG&E and, in many cases, to offer electricity generated by clean, renewable power sources.

The initiative is in its earliest stages, and it likely would not be placed on the state ballot until the June 2010 election. At this point, "it’s unclear how much of a campaign it’s going to be," according to Greg Larsen of the Sacramento public relations firm Larsen Cazanis, a spokesperson for the effort. "It’s a long way off."

That hasn’t stopped local CCA supporters from sounding alarm bells. "Urgent/Bad! PG&E State Ballot Measure To Kill Public Power & CCA," public power activist Eric Brooks wrote in the subject line of a widely disseminated e-mail last week. "It’s red alert time boys and girls," he wrote, saying the proposal "will kill all new Public Power and Community Choice Aggregation projects statewide."

Brooks isn’t alone: everyone the Guardian spoke with who is involved in the creation of San Francisco’s CCA voiced concern that the proposal could kill any future community choice efforts.

The proposed initiative was submitted to the California Attorney General’s office May 28 with the contact listed as the Sacramento law firm Nielsen, Merksamer, Parrinello, Mueller & Naylor, a powerful player with a long history of working with PG&E on ballot initiatives. Larsen confirmed that PG&E had provided the $200 filing fee, the only amount spent so far on the embryonic proposal.

The official proponent of the initiative is Robert Lee Pence, apparently the same person who was listed as an opponent of Proposition 80, a 2005 ballot measure that dealt with utility regulation. Opposition to Prop. 80 was heavily funded by PG&E and other utilities, and the initiative failed by a wide margin.

Pence’s group, Californians for Reliable Electricity, listed Steve Lucas as a contact on 2005 campaign documents. Lucas is also listed as the point person at Nielsen, Merksamer, Parrinello, Mueller & Naylor for questions regarding the Taxpayers Right to Vote Act.

The address listed for the organization is the same as that of Townsend, Raimundo, Besler and Usher — a Sacramento political consulting firm that also has a long history of working with PG&E on political campaigns. When asked about the PR firm’s role in the Taxpayer Right to Vote Act, Larsen acknowledged that they "may be involved as the campaign goes forward," but cautioned that any discussion so far has been preliminary.

The rationale behind the initiative is to protect taxpayers, Larsen said, because CCA programs "are major issues that communities undertake and require millions or billions of public dollars." The proposed initiative, he said, seeks to "ensure that voters — and frankly, their descendents — who will wind up being responsible for these programs have a say." If the measure passes, Larsen added, voters could still approve CCA programs — but with two-thirds of the vote, a supermajority that he contends is "staying in line with many other California requirements."

California Sen. Mark Leno, however, has a very different opinion. "I would hope that Californians would have come to understand that two-thirds vote thresholds are probably more responsible for damage to the state of California in the past 30 years than any other single factor," he said. "To hand a small minority controlling power is anti-democratic. This must be defeated." Leno also said he believes that the initiative would have drastic consequences for CCA programs if it passes.

Meanwhile, local CCA supporters say there is more to this than merely sticking up for taxpayers’ rights. If programs like Clean Power SF — the CCA initiative currently being developed in San Francisco — are fully implemented, then PG&E, which makes good money from its monopoly status, would face some actual competition. Naturally, the powerful utility would have an incentive to eliminate the alternative altogether.

Under the current system, PG&E "has to rely on the elected officials to kill CCA, and its much harder … to do that," says John Rizzo of the San Francisco Bay Chapter of the Sierra Club. But if the Taxpayers Right to Vote Act is enshrined in state law, "they could just pour in money and spread propaganda. Particularly the two-thirds requirement is just outrageous — it basically makes it impossible" to secure approval for any step toward CCA implementation.

"It’s a nasty ballot initiative," Mike Campbell, director of San Francisco’s CCA at the Public Utilities Commission, told us. "I think it’s clearly aimed at the heart of CCA." Campbell added that while he has been in discussion with SFPUC staff and others involved in hammering out Clean Power SF, he wasn’t at liberty to discuss a strategy for fighting the proposed initiative just yet.

Ross Mirkarimi, who chairs the city’s Local Agency Formation Commission — the body tasked with working in tandem with the SFPUC to implement San Francisco’s CCA — called the proposal "heinous — and yet I expect nothing less from PG&E.

"They can try to win by well-funded misinformation blitzkrieg," Mirkarimi noted. "If they’re able to spend $10 million without blinking here in San Francisco [on defeating a public power measure], they’re poised to spend tens of millions on this. As a state battleground, this elevates the fight that much more. We have to act in solidarity with other municipalities. We should be well-armed in repudiation of this effort."

There may be ways to attack the initiative in advance. The CCA legislation bars private utilities from seeking to undermine local CCA efforts. Assembly Member Tom Ammiano told us that the Legislature should look at how PG&E could be blocked from mounting a statewide effort to kill CCAs. "I think there’s some potential there," he said.

Julian Davis, who chaired the Prop. H campaign for public power last year, said he found the proposal very worrisome. "If you shut down community choice, you’re shutting down one of the major vehicles for clean energy," he said. To Davis, the initiative highlights "a disturbing trend of corporate America finding ever-more clever ways of tying the hand of local government in general. You know they’ll dump millions into this," he added. "The ultimate irony here is that none of us have the right to vote on anything PG&E does. None of us has a seat at the PG&E board table. It’s doublespeak."

Eliminating dissent

For years, the Hunters Point Shipyard Restoration Advisory Board has served as the Bayview-Hunters Point community’s main voice in the U.S. Navy’s environmental cleanup plans for the toxic former naval station. But the committee is suddenly being disbanded just as the cleanup enters a crucial phase.

Used for shipbuilding and submarine maintenance and repair, and the decontamination, storage, and disposal of radioactive and atomic weapons testing materials, the shipyard was added to the Superfund national toxic site cleanup list in 1989. But it is also at the heart of where Mayor Gavin Newsom has partnered with Lennar Corp. on the city’s biggest development proposal, involving 10,500 homes and a new stadium for the 49ers.

As the Navy prepares to release a series of important studies and reports concerning the cleanup of the dirtiest parcels on the former shipyard, community members were outraged by the Navy’s announcement in late May that it is preparing to dissolve the RAB in the next 30 days.

In July the Navy will release draft feasibility studies for the cleanup of Parcel E, along with a final remedial investigation/feasibility study for Parcel E2, the dirtiest parcel on the base, and a radiological data-gathering investigation in the sediment surrounding Parcel F, which is the underwater portion of the base.

Some insiders say the announcement was not unexpected, given an escautf8g series of confrontational RAB meetings with the Navy over the last two years. But they fear the community will lose its ability to give the Navy direct, timely, and meaningful feedback, even if many believe the Navy wasn’t listening.

"The Navy fully supports the need for open, meaningful dialogue with the diverse Bayview-Hunters Point community regarding our environmental cleanup actions and decisions. However, the RAB is not fulfilling this objective," the Navy’s Laura Duchnak wrote in a May 22 letter to the RAB.

In her letter, Duchnak said the RAB meetings no longer provide community input on the Navy’s environmental cleanup program, that their atmosphere is not productive to effective public discourse, and that Navy attempts to improve the process have failed. "The revised community involvement program may include community environmental forums, including using Internet-based technologies to more easily reach a diverse audience, expanded monthly progress reports and fact sheets, and hosting technical discussions and tours of cleanup sites for interested community members," Duchnak wrote.

Duchnak’s announcement followed a tense January meeting in which RAB members reacted with horror when the Navy announced it was moving forward with controversial plans to cap radiologically-affected areas on the shipyard’s Parcel B instead of digging and hauling them, which the community preferred (see "Nuclear Fallout," 07/16/08).

Led by RAB co-chair Leon Muhammad, who teaches at the Nation of Islam’s Center for Self Improvement, which has been repeatedly dusted by unmonitored asbestos (see "The corporation that ate San Francisco," 03/17/07), and joined by newly sworn-in members Archbishop King, Marie Harrison, and Daniel Landry, the board voted to seek a civil grand jury investigation into whether local truckers are getting their fair share of the Navy’s shipyard contracts.

Members then voted to remove the city’s public health representative Amy Brownell from the RAB, and to call for the stoppage of all work on the yard until the Department of Defense, the Navy, and the city can prove, as Muhammad said, "where the ongoing dust exceedences are coming from."

The final straw, insiders say, occurred in February when members voted to remove the Navy’s RAB co-chair Keith Forman from the advisory board. Eric Smith, who was sworn onto the RAB in January but did not vote to remove Brownell and Forman, said the Navy’s dissolution response wasn’t surprising.

"The dissolution of RAB is not a good thing in terms of what it is supposed to do. But it was also doing things that were dysfunctional," Smith said. "The bitter irony is that the folks who caused the trouble were trying to get the Navy to sit up and take notice."

Smith said there is frustration with the Navy’s communication style, which the community feels is patronizing. "But the RAB was naïve to think the Navy would allow a forum over which it has unilateral authority to become a platform for attacks," Smith said.

RAB member Kristine Enea, who missed the RAB’s last two meetings, confirmed that the atmosphere got increasingly confrontational but added that the Navy ignored suggestions her calls for wider community involvement.

"It’s ironic that the Navy had decided to respond to criticisms, which include the charge that it is a poor communicator, by cutting off communications with the community," said Enea, who works at the India Basin Neighborhood Association. "Dissolving the RAB is a drastic step. There is so much going on, and so much that we need to know."

But Enea hopes IBNA can help fill that void, noting that the association has applied for a US Environmental Protection Agency technical assistant grant to review shipyard clean-up documents, provide fact sheets, and host community meetings.

The Sierra Club’s Arthur Feinstein said that his group’s main concern around the dissolution is that Parcel E2, which contains an industrial and radiologically-impacted dump that burned for six months in 2000, and Parcel F are both coming up for analysis.

"These are some of the most significantly contaminated areas on the shipyard, so the timing is terrible," Feinstein told the Guardian, observing that some RAB members did not appear to be looking for solutions and were so aggressive they destroyed meetings.

"Unfortunately there weren’t enough forceful people to say ‘shut up and sit down,’" Feinstein said. "But without a RAB, there will be no public forum where folks are able to get and read materials ahead of the meeting, and then ask and submit questions."

Harrison, a member of the environmental justice group Green Action, believes the Navy’s intent is that there be no meaningful interaction with the community. "When you don’t toe the line and play like good little children, the Navy shuts you down," said Harrison, whose group, along with the Nation of Islam and the Caravan for Justice, are planning a June 30 demonstration at the shipyard to protest the move.

In another point of controversy, Sen. Mark Leno has legislation that seeks to trade 25 percent of Candlestick Point State Recreation Area, the only major piece of open space in the Bayview, for small strips on the shipyard so Lennar can build condos on the parkland.

Noting that Sen. Leland Yee and Assembly Members Tom Ammiano and Fiona Ma oppose the parks-for-condos plan (see "Going Nuclear," April 29), Harrison said, "What possessed anyone to believe that we’d say, okay, take the only open space in the Bayview, and in exchange we’ll accept contaminated land scattered around on the shipyard?"

Environmental advocates believe the Sierra Club intends to fight Leno’s legislation with a challenge under the California Environmental Quality Act, but Leno told the Guardian that he is "continuing to work and meet with the lobbyists for the Sierra Club here in Sacramento to see if there are any additional amendments we can take that would get them to a neutral position on the bill.

"I think there is a good possibility we can get there," Leno said.

In February, Arc Ecology released a 133-report titled "Alternatives for study" that recommended the removal of the Parcel E2 landfill and explored changes in land use arrangements in the current redevelopment proposal to avoid environmental impacts (see "Concrete Plans," Feb. 4). Unfortunately, they were largely ignored by the Mayor’s Office of Economic and Workforce Development, which is working with Lennar on the public-private development deal.

Arc Ecology executive director Saul Bloom remains undaunted, recalling how 87 percent of voters citywide supported Proposition P, an advisory measure he wrote and that then-Sups. Ammiano, Leno, Michael Yaki, and the late Sue Bierman placed on the ballot in 1989 to establish community acceptance criteria for the shipyard, under federal toxic cleanup guidelines.

"The Navy had offered their opinion that voters in San Francisco, and especially in the Bayview, would accept a nonresidential industrial level cleanup for the shipyard because they were primarily interested in jobs," Bloom recalled. "We said that this was a mischaracterization and we’d go ahead and prove them wrong."

He believes the current struggle with the Navy over the RAB, and with the city and Lennar over Arc’s alternatives, are "emblematic of the problem facing the Bayview with regard to accessing good information and being told the straight story on health and development issues."

The most painful and divisive city budget season in many years was just getting under way as this issue went to press, with dueling City Hall rallies preceding the June 16 Board of Supervisors vote on an interim budget and the board’s Budget and Finance Committee slated to finally delve into the 2009-10 general fund budgets on June 17.

Both sides have adopted the rhetoric of a life-or-death struggle, with firefighters warning at a rally and in an advertising campaign that any cuts to their budget is akin to playing Russian Roulette, while city service providers say the deep public health cuts proposed by Mayor Gavin Newsom will also cost lives and carry dire long-term costs and consequences.

Despite Newsom’s pledges in January and again on June 1 to work closely with the Board of Supervisors on budget issues, that hasn’t happened. Instead, Newsom’s proposed budget would decimate the social services supported by board progressives, who responded by proposing an interim budget that would share that pain with police, fire, and sheriff’s budgets — which Newsom proposed to increase.

Rather than simply adopting the mayor’s proposed budget as the interim spending plan for the month of July, as the board traditionally has done, progressive supporters proposed an interim budget that would make up to $82 million in cuts to the three public safety agencies and use that money to prevent the more draconian cuts to social services.

“It’s the start of a discussion to figure out what that number should be. I don’t know where we’re going to end up,” Sup. David Campos, who sits on the budget committee, told us.

Board President David Chiu said Newsom did finally meet with him and Budget Committee chair John Avalos on June 15 to try to resolve the impasse. But he said, “We didn’t hear anything from the mayor that would change where we were last week.” They planned to meet again on June 19.

“What we proposed represents the magnitude of the challenge we face this year,” Chiu said of the interim budget proposal, seeming to indicate that supervisors are open to negotiation.

The real work begins the morning of June 17 when the Budget and Finance Committee dissects the budgets of 15 city departments, including the Mayor’s Office, of which Avalos told us, “I don’t think the mayor has made the same concessions as he’s had other departments make.”

The next day, another 13 city departments go under the committee’s microscope, including the public safety departments that were spared the mayor’s budget ax and even given small increases, and the budget of the Public Defenders Office, where Newsom proposes cutting 16 positions.

“This creates a severe imbalance in the criminal justice system,” Public Defender Jeff Adachi told us. “Why is he cutting public defender services while fully funding police, fully funding the sheriff’s department, and essentially creating a situation where poor people are going to get second-rate representation?”

That theme of rich vs. poor has pervaded the budget season debate, both overtly and in budget priorities that each side is supporting.

 

BUDGET JUSTICE

Hundreds of people whose lives would be affected by cuts marched on City Hall under the banner Budget Justice on June 10. Some of San Francisco’s most vulnerable citizens, including homeless people, immigrants, seniors, and public housing residents, turned out for the march, chanting and waving signs asking the mayor to “invest in us.”

Sups. John Avalos and Chris Daly delivered resounding speeches mirroring the anger in the crowd, and promised to fix the budget by reallocating money to protect the city’s safety net. Daly charged that even as services to the city’s vulnerable populations are being slashed, “the politically connected and the powerful get huge increases.”

Avalos took the podium just before heading into City Hall to lead the Budget and Finance Committee meeting and implored the hundreds of people gathered out front to make their voices heard. “Mayor Newsom, he told us, he said, ‘We have a near-perfect budget.’ Do we have a near-perfect budget?” Avalos asked, and then paused while the crowd cried out, “Nooo!!!!!”

During an interview discussing Newsom’s budget priorities, Avalos twice made references to The Shock Doctrine, using the Naomi Klein book about how crises are used as opportunities to unilaterally implement corporatist policies. “We have a budget deficit that is real, but it’s being used to do other things,” Avalos said. “I look at it as a way to remake San Francisco. It’s a Shock Doctrine effect.”

He referred to the privatization of government services (an aspect of every Newsom budget), promoting condo conversions and gentrification, defunding nonprofits that provides social services (groups that often side with progressives), and helping corporations raid the public treasury (Newsom proposed beefing up the Mayor’s Office of Economic and Workforce Development by a whopping 32 percent).

“It’s things that the most conservative parts of San Francisco have wanted for years, and now they have the conditions to make it happen,” Avalos said.

Much of that agenda involves slashing services to the homeless and other low-income San Francisco and de-funding the nonprofit network that provides services and jobs. “There’s an effort to say nonprofit jobs aren’t real jobs, but they are an important economic engine of the city,” Avalos told us. Those cuts were decried during the June 10 budget rally.

“What people don’t realize,” Office & Professional Employees International Union Local 3 representative Natalie Naylor said, “is that everything that’s being proposed to be cut from the city is creating no place for homeless people to go during the daytime. I don’t think Newsom’s constituents realize that we’re going to see more homeless people on the street than ever before.”

Pablo Rodriguez of the Coalition on Homelessness told the crowd that he was furious that the mayor would make such deep cuts to social services. “Stop riding on the back of the homeless, and the seniors and the children and all the community-based organizations,” Rodriguez said. “Why make the poor people pay for the rich people’s mistakes? The poor people didn’t make the mistakes.”

 

WHOM TO CUT?

The public safety unions were equally caustic in their arguments. An announcement for the Save Our Firehouses rally — which was heavily promoted by members of the Mayor’s Office and Newsom’s gubernatorial campaign team — claimed that “the Board of Supervisors voted to endanger the progress that we’ve made in public safety by laying off hundreds of police officers, closing up to 12 out of 42 fire stations and closing part of our jail.”

Actually, all sides have said the interim budget probably won’t lead to layoffs, station closures, or prisoner releases, but those could be a part of next year’s budget.

Tensions temporarily cooled a bit in the days that have followed, but the two sides still seemed far apart on their priorities, mayoral spin aside. Asked about the impasse, Newsom spokesperson Nate Ballard told the Guardian, “The mayor has already included over 90 percent of the supervisors’ priorities in the budget. But he’s against the supervisors’ efforts to gut public safety. He’s willing to work with people who have reasonable ideas to balance the budget. Balancing the budget with draconian cuts to police and fire is unreasonable.”

Campos disputed Ballard’s figure and logic. “I don’t know where that number comes from,” Campos said. “A lot of the things we wanted to protect, the mayor cut anyway.”

Campos said Newsom’s slick budget presentation glossed over painful cuts to essential services, cuts that activists and Budget Analyst Harvey Rose have been discovering over the last two weeks. “I felt the mayor has done a real good job of presenting things to make it look like it’s not as bad as it really is,” Campos said.

 

COMMITTEE WORK

Avalos expressed confidence that his committee will produce a document to the full board in July that reflects progressive priorities.

“We’re going to pass to the full board a budget that we have control over,” Avalos said, noting that a committee majority that also includes Sups. Campos and Ross Mirkarimi strongly favors progressive budget priorities.

He also praised the committee’s more conservative members, Sups. Bevan Dufty and Carmen Chu, as engaged participants in improving the mayor’s budget. “I think the tension on the committee is healthy.”

Ultimately, Avalos says, he knows the board members can alter Newsom’s budget priorities. But his goal is to go even further and develop a consensus budget that creatively spreads the pain.

“Ideally, I want a unanimous vote on the Board of Supervisors,” Avalos said.

In the current polarized budget climate, that’s an ambitious goal that may be out of reach. But there are some real benefits to attaining a unanimous board vote, including the ability to place revenue measures on the November ballot that can be passed by a simply majority vote (state law generally requires a two-third vote to increase taxes, but it makes provisions for fiscal emergencies, when a unanimous Board of Supervisors vote can waive the two-thirds rule).

Avalos has proposed placing sales tax and parcel tax measures on the fall ballot. Other proposals that have been discussed by a stakeholder committee assembled by Chiu include a measure to replace the payroll tax with a new gross receipts tax and general obligation bond measures to pay for things like park and road maintenance, which would allow those budget expenses to be applied elsewhere.

But Avalos said Newsom will need to step up and show some leadership if the measures are going to have any hope of being approved. “To get the two-thirds vote we need to win a revenue measure in this bad economy is going to be really hard,” Avalos said.

“The mayor is open to new revenue measures as long as they include significant reforms and are conceived and supported by a wide swath of the community including labor and business,” Ballard said.

Sup. Sean Elsbernd — one of the most conservative supervisors — has repeatedly said he won’t support new revenue measures unless they are accompanied by substantial budget reforms that will rein in ballooning expenditures in areas like city employee pensions.

“Pension reform. Health care reform. Spending reform. One of the above. A combination of the above,” Elsbernd told the Guardian when asked what he wants to see in a budget revenue deal.

Avalos says he’s mindful that not every progressive priority can be fully funded as the city wrestles with a budget deficit of almost $500 million, fully half the city’s discretionary budget. “It’s a crappy situation, and we can make it just a crummy situation.”

Lark Creek Inn re-opens as Tavern at Lark Creek
Larkspur’s shining jewel is Lark Creek Inn, a gorgeous yellow and white 1880’s Victorian where the classic restaurant resided for 20 years. In keeping with the economy, the inn closed some months ago to make way for a more affordable, casual Tavern at Lark Creek, which debuted June 4th. Open nightly, with brunch on Sundays, the new menu has nothing over $15, a kindly move, especially when you’re getting the likes of Devil’s Gulch Ranch rabbit terrine, Mizuna salad with Medjool dates, Pt. Finally, justice

It’s not every day a journalist helps overturn life sentences and win multimillion dollar settlements for the aggrieved parties. But that’s exactly what happened last week when San Francisco reportedly agreed to pay $4.5 million to John Tennison, who spent 13 years behind bars for a crime he didn’t commit.

Tennison and his alleged accomplice, Antoine Goff, who were sentenced to life for the execution of Roderick "Cooley" Shannon in 1989, were still behind bars when former Guardian reporter A.C. Thompson dug into their case in 2001.

At the time police linked Shannon’s murder to a war between hoodsters in Visitation Valley and Hunter’s Point over control of the drug trade. Tennison and Goff both had alibis. As Thompson revealed ("The Hardest Time," 01/17/01), witnesses were coached to lie that the pair had committed the murder. In addition, defense lawyers weren’t told about witnesses who said the men were innocent or that a man named Lovinsky Ricard confessed to the crime.

When the Guardian published "The Hardest Time" as a cover story in 2001, Tennison’s brother, who worked in a parking lot near the Keker & Van Nest law office, put copies on the windshield of every car hoping lawyers would read it and offer to help. That’s what happened.

Two of the Keker firm’s associates, Ethan Balogh and Elliot Peters, picked up the case and helped SF Public Defender Jeff Adachi and a team of lawyers win Tennison and Goff’s freedom, working for three years pro bono.

Although it’s a triumph that the city agreed to compensate Tennison (a similar claim by Goff is pending), Shannon’s killer is still at large. In addition, former SF Police Chief Earl Sanders, detective Napoleon Hendrix, and prosecutor George Butterworth walked away without so much as a reprimand, even though Thompson ("The Chief’s other legal problem," 03/05/03) suggested they may have unethically helped put Tennison and Goff behind bars.

In 2003, when Tennison’s sentence was overturned, Thompson wrote: "After my journalistic probe, I felt fairly certain that a terrible injustice had been done, that Tennison and Goff had not killed Shannon, that police and prosecutors had engaged in dubious behavior, and that the real executioner was walking the streets. Still, I never expected the two men to go free. The criminal justice system is stacked against convicts who assert their innocence."

The deadbeat church

The Roman Catholic Archdiocese of San Francisco is trying to duck paying as much as $15 million in city taxes, according to documents filed by the city assessor’s office.

Assessor-Recorder Phil Ting argues that the archdiocese, which governs a collection of churches, schools, parking lots, commercial buildings, and other real property in the city, shifted 232 parcels of land from two church-held corporations to another church corporation in April 2008, triggering real estate transfer taxes.

The legal issues are complicated, and church lawyer Philip Jelsma wouldn’t return our calls, but the city officials say the deal amounts to this: The archdiocese is moving valuable property out of the hands of a corporation that might be liable for legal claims and into a separate entity that would be exempt from those claims.

And the church is taking two contradictory positions on the reorganizing. According to documents from the Assessor-Recorder’s Office, when the archdiocese is discussing the protection of its assets from litigants, it claims that the legal entities in question are separate and distinct under civil law. However, when the city comes calling for much needed transfer tax dollars, church officials argue that the entities are merely interdenominational under the common banner of the Roman Catholic Church and that the transfers are considered "gifts" under canon law.

The issue comes before the Transfer Tax Board of Review on June 16. If the board, made up of the controller, the tax collector and the head of the Department of Real Estate, upholds Ting’s position, the city will be able to collect between $3 million and $15 million, depending on the assessed value of the transferred parcels.

Major corporations in San Francisco have a long history of using bogus property transfers and shifts in corporate ownership to avoid paying property and transfer taxes. But this case is a bit more curious: why is the Roman Catholic Archdiocese, self-proclaimed champion of the poor, fighting tooth and nail to keep the city from collecting tax dollars that would help fund public welfare programs?
