› news@sfbg.com If November has been a bad month for Mayor Gavin Newsom, it’s been worse for his police chief, Heather Fong. The entire battle over police foot patrols has made Fong look terrible. She started off saying that the department simply couldn’t afford to put more cops on the streets in high-crime areas because she didn’t have the troops to do it. She and the mayor fought hard to defeat the legislation. The bill passed anyway, effectively ordering her to do what she claimed she couldn’t do, and it was vetoed by Newsom. But as it seemed likely that the Board of Supervisors had the votes to override the veto, Fong came out with her own foot patrol plan, which wasn’t all that different from what the board had approved. Suddenly, she seemed to be saying that foot patrols really were possible. After the veto override she went in another direction, telling a TV interviewer that she wasn’t sure her captains were going to follow the law anyway. Police Commission member David Campos pushed her on those apparent flip-flops at the commission’s Nov. 15 meeting, and she bobbed and ducked like a wounded quail. In the meantime, at least one Newsom ally, Sup. Bevan Dufty, proclaimed that he had no faith in the chief, and numerous others on the board publicly decried her lack of leadership. Fong sat in the board chambers Nov. 14, looking visibly shaken, and listened to it all. And rumors started swirling that Newsom was ready to fire her. Not a good sign for the city’s first female top cop, who was already under fire for the skyrocketing murder rate and for failing to hold bad officers accountable for abuses of authority. But Fong has one thing going for her: some progressives think that the immediate alternatives are even worse. Campos, a proponent of foot patrols, told us he was critical of the chief’s reaction to the supervisors’ plan — a plan that the board only decided to implement after watching crime levels rise for three years straight and gaining unanimous backing from the Police Commission and significant support from a frustrated public. But he’s not so sure giving Fong the ax will help. “I understand the criticisms,” Campos told us, “but as a progressive, I’m worried what will happen to police reform if Fong is no longer there. Under her leadership we’ve seen a dramatic change in approach from that of her predecessors. There’s been less conflict, and her focus has been on how to get the job done without drama. She’s not a bomb thrower, and that’s been a real positive change.” The politics of the situation are complicated: sure, some progressives are furious at the chief — but a lot of the pressure to get rid of her is also coming from the police union and the old guard at the department. “Some of the people who are critical of her are those who also aren’t keen on reform and have tried to slow down the reform promises contained within Prop. H,” Campos explained. “To me, that raises my concern. I don’t want those people to succeed in their efforts. Their track record has not been good.” Sup. Tom Ammiano added, “You can change the chief, but that won’t address the real problems.” Commission member Theresa Sparks noted that “Chief Fong has brought a strong sense of integrity and a lot of administrative order to the department and made some changes of command staff. My only concern is the willingness of the rank and file to follow her leadership, given that she has such a different leadership style.” Sparks argued that whenever Fong leaves, the commission ought to go beyond the traditional practice of promoting from within. “There’s a number of qualified people within the department who certainly should apply,” she said, “but San Francisco might benefit from looking farther afield, much like Los Angeles did.” There will, no doubt, be tremendous pressure to hire from within the ranks. Dufty — who, to his credit, defied the mayor and voted to overturn the foot patrols veto — is a fan of Deputy Chief Greg Suhr. Yet Suhr was one of the so-called Fajitagate defendants charged with conspiracy, although the charges against him were dismissed in court. He was in command of 100 officers during an anarchist demonstration in the Mission District in July 2005 when patrol officer Peter Shields was overwhelmed by protesters and injured. (That was the demonstration that led to the jailing of journalist Josh Wolf — see Editor’s Notes, on the cover.) Suhr blamed a communications breakdown; Fong said that wasn’t possible. Suhr was exiled to a job with the SF Public Utilities Commission shortly afterward. Police reform activists don’t consider Suhr an ally, but Dufty called him “a very strong cop.” Even so, Dufty agreed that the department might benefit from outside leadership. “We’re at a stage where the balkanization of the department is at a level I’ve never seen,” he told us. “I’ve never thought that there should be a chief from the outside, but at this time I would consider it.” SFBG

The devil in the metadata

The Rules Committee of the Board of Supervisors is considering whether or not the city should allow its departments to release electronic documents that include metadata. Although the Sunshine Ordinance Task Force has already hashed over the minutiae of this issue and ruled that metadata can and should be released, the mystery enshrouding what it is, and the lack of any specific policy or known precedent in other cities or states with public records laws has pushed the discussion upstream to where a formal legislation has become a possibility.
Freedom of information purists are saying all the parts and pieces of a document are part of the public domain, while the City Attorney’s Office is claiming another layer of protection may be required.
Metadata entered the realm of public discussion in San Francisco after citizens started making requests of electronic documents with a specific plea for metadata. Activists Allen Grossman and Kimo Crossman wanted copies of, ironically enough, the city’s Sunshine Ordinance, in its original Microsoft Word format. Grossman and Crossman wanted to use the advantages of technology to follow the evolving amendments the Sunshine Ordinance Task Force members were considering for the city’s public records law. These “tracked changes” are a common function in Word, and are, technically, metadata.
When Clerk of the Board Gloria Young received these specific requests for Word documents, not knowing what this “metadata” was or what to do about it, she turned to the office of City Attorney Dennis Herrera for advice.
Deputy City Attorney Paul Zarefsky initially gave oral advice to Young, and when pressed by the Sunshine Ordinance Task Force, issued a five-page memo in response, arguing that release of documents with metadata could pave a path for hackers into the city’s computer system, render documents dangerously vulnerable to cut-and-paste manipulation, and invite another unwelcome burden of reviewing and redacting for city officials. Young followed his advice and proffered the requested documents as PDFs.
A PDF, or “portable document format,” is essentially a photograph of the real thing, and contains none of the metadata that exists a couple clicks of the mouse away in a Word document. Evolving changes can’t be tracked, and PDFs don’t have the same searchability that Word docs have. So PDFs of the Sunshine Ordinance that Young provided didn’t have the functions that Crossman and Grossman were looking for, and were utterly useless for their purposes.
“It’s 92 pages,” Grossman said of the PDF Sunshine Ordinance. “I can’t search it electronically if I want to find something. This document I received is of no use to me.”

Meta-what?
Before delving too deep into the intricacies of current city politics, let’s pause for a moment to note that you don’t need to be a Luddite to have no idea what metadata is. It sounds like some diminutive or ethereal version of the real thing. In a sense, it is.
Simply put, metadata is data about data, and grows with weed-like tenacity in the electronic flora of the twenty-first century. Common examples include the track an email took from an outbox to an inbox, details about the owner of a computer program, or the laptop on which a Word document has been typed.
Metadata becomes cause for concern when there is something to hide. Not readily visible, metadata requires a little sleuthing to reveal, but in the past it’s been used to uncover deeper truths about a situation. For example, attorney Jim Calloway relates on his Law Practice Tips blog a divorce case where custody of the child was called into question because of the content of emails sent from the mother to the father. The mother denied she’d sent the emails, though the father vehemently insisted she had. A court forensics investigation found metadata showing that, in reality, the father had written the emails and sent them to himself.
“Metadata speaks the truth,” Calloway writes. “My position has always been that a tool is a tool. Whether a tool is used for good or evil is the responsibility of the one who uses the tool.”
Lawyers have historically advised that metadata be fiercely protected. Jembaa Cole, in the Shidler Journal for Law, Commerce and Technology wrote, “There have been several instances in which seemingly innocuous metadata has wreaked professional and political havoc.”
Cole goes on to cite a gaffe from Tony Blair’s administration – a document about weapons of mass destruction was available on the government’s web site, which claimed the information was original and current. Metadata showed that, not only had the information been plagiarized from a student thesis, it was more than ten years old.
Cole urges lawyers to take an aggressive tack against revealing metadata, by educating offices about its existence, making a practice of “scrubbing” it from documents, and providing “clean” documents in PDF or paper form.
The city attorney’s office has taken a similar stance. Spokesperson Matt Dorsey told us metadata has been a part of the continuing education of the city attorney’s office. However, all past case law of which they are aware focuses on metadata in the context of discovery and “the conclusion of most state bars is that they have the obligation, under attorney-client privilege, to review metadata prior to discovery,” he said. “The issue of metadata is a relatively new one in legal circuits. It isn’t a brand new issue to us, but it is in the context of Sunshine,” said Dorsey, who maintains that metadata could still fall within the standard redaction policies of the public records act.
Terry Franke, who runs the open-government group Californian Aware, argues that “the city attorney needs to complete this sentence: ‘Allowing the public to see metadata in Word documents would be a detriment because…’ What?”
“From the beginning of this discussion the city attorney has never provided a plausible, practical, understandable explanation of what is the kind and degree of harm in allowing metadata to be examined that justifies stripping it out,” Francke said.

To the task force
When Grossman and Crossman were denied the documents as they’d requested them, they filed complaints with the Sunshine Ordinance Task Force. In their cases, first heard on Sep. 26, they argued there should be no concern that the text of Word documents could be manipulated – anybody with a gluestick and a pair of scissors could do that to any piece of paper. That had been a consideration when the Sunshine Ordinance was drafted, and why the city always retains the undisputable original.
Thomas Newton, of the California Newspapers and Publishers Alliance, who was involved in drafting the state’s public records law, agreed with them. “If you follow his logic, you can’t release a copy of any public record because, oh my God, someone might change it,” Newton told us.
Crossman and Grossman also pointed out that to convert documents from Word to PDF invites even more work to a task that should be as burden-free as possible. It’s a regular practice for the clerk of the board to maintain documents as PDFs because that preserves signatures and seals of ratified legislation, but to make it a policy of all departments could invite a landslide of work, printing out documents and converting them to PDFs – not to mention undermining the notion of conserving paper.
Also, translation software and the “screen reader” feature that a blind person might employ to “read” an electronic document, don’t work with PDFs.
First amendment lawyers also offered written opinions on the issue. “Some of the city’s arguments have no support in the law whatsoever,” wrote Francke. “The fundamental problem for the city is that it has no authority to legislate a new general exception of exemption from the CPRA (California Public Records Act), and that’s what’s being advanced here.”
“The city’s scofflaw position represents the status quo ante, the old law that used to allow an agency to provide a copy of computer data ‘in a form determined by the agency.’ The city’s position has been directly and completely repudiated by the legislature. If the city disagrees with the law, it should come to Sacramento and get a bill,” wrote Thomas Newton, general counsel for the California Newspaper Publishers Association (CNPA).
As for the hacker scare, Zac Multrux, an independent technology consultant was invited to the Sep. 26 hearing by task force member Bruce Wolfe to speak about the dangers of metadata. He suggested a number of technological tools that are available for purchase or are free online, that will “scrub” metadata from documents. He said that while it’s true that someone with ill intent could mess with metadata, “I think someone would need a whole lot more than the name of a computer” to hack into the city’s system. “Personally, I don’t see it as a significant security risk,” he said.
It was also pointed out at the hearing that a variety of city, state, and federal departments already make Word and Excel documents available. Wolfe did a quick online search and found more than 96,000 Word documents on the State of California web site. “They’re not afraid to make Word documents public online,” he said.
Over the course of two hearings the task force found no basis for Zarefsky’s claims in either the city’s law or the California Public Records Act – both of which explicitly state a document should be released in whatever format is requested, as long as the document is regularly stored in that format or does not require any additional work to provide.
The task force found Young in violation of the ordinance and she was told to make the documents available in Word format. No restrictions or rulings were made for future requests, but task force member Sue Cauthen said, “I think this whole case is a test case for how the city provides documents electronically.”

What’s next?
As requested, Young had the Sunshine Ordinance, in Word format, pulled from the city’s files and posted on a separate server outside of the city’s system to be viewed. Crossman, noting the added labor and resources for that provision, wondered if that would happen to all public records requested in Word format, so he cooked up another request to test his theory.
He asked for all the pending and accepted legislation for the month of September from the Board of Supervisors, in Word format.
While the Sunshine Ordinance Task Force had found that withholding documents because of metadata was against the law, redaction of privileged information is still legally necessary, and Young continued to follow the city attorney’s advice that a PDF with no metadata was still the safest, easiest way to comply. She told us, “I don’t take their advice lightly.”
Zarefsky’s opinion said departments “may” provide PDFs instead of Word documents and that “metadata may include a wide variety of information that the City has a right — and, in some cases a legal duty — to redact. Young’s office does have pending legislation in Word format, she says it does not fall within the expertise of her staff to review and redact the metadata in those documents because they didn’t author them. “Since we don’t create the documents, how could we ever know whether the metadata should be released? We don’t know what it is,” she told us. “We couldn’t even hire expertise that would know.”
“I can’t imagine there’s so much toxic stuff in Board of Supervisors records they can’t let out,” Grossman told us. “This is a whole mystery to me.”
“It’s just data,” says Crossman. “City employees created it on our dime. Unless it falls under redaction discretion, entire documents should be provided.”
Young took the issue to the legislators who do draft the legislation, asking the November 2 meeting of the Rules Committee for further policy consideration. Miriam Morley spoke on behalf of the city attorney’s office, and said there was a sound legal basis for providing documents as PDFs, but that this was an evolving area of the law that the city attorney’s office wasn’t aware of until about 9 months ago. They could find no other cities currently grappling with the issue, but she said, “Our conclusion is that a court would likely hold a right to withhold a document in Word.”
The committee decided to research the issue further before making a ruling. Committee chair Ross Mirkarimi said he had been integral to the drafting of the Sunshine ordinance, and to rush a decision could be detrimental.
“It seems to me in the spirit of the Sunshine law this is something we should really look at,” Tom Ammiano said. It’s currently at the call of the Chair of Rules and no date has been set for the Rules Committee to hear it again.
A policy in San Francisco could set a real precedent for public records law, but according to many first amendment lawyers, for the Board to do so would be a violation of state law. “I know of no other city, county, or subdivision of state government or state agency that’s disregarding the clear intention of the law as some elements of San Francisco city and county government are planning to do,” Newton told us.
“It’s a debate that can’t really occur outside of a proposal to change the state law,” he said. “The Board of Supervisors can’t pick and choose which law to comply with,” and he said the state’s constitution and public records act trumps the city, which is reading the law too narrowly. “They’re required to give a broad interpretation of this access law. If they don’t like it they should come to Sacramento and get a bill,” he said.
“I think a lot of city departments, and policy and advisory bodies can save themselves a lot of headaches by declaring as policy that they will provide documents in their original formats,” task force member Richard Knee said. “With metadata.”

Now the police are all on foot patrols, pass the pot, huh?

It hasn’t exactly been a good couple of weeks for Mayor Gavin Newsom.
His picks for Board of Supervisors got thumped.
The 49ers said they’re running away with Santa Clara but keeping San Francisco’s name.

And then the Board of Supervisors overrode Newsom’s veto of police foot patrol legislation in a 9-2 vote that means the city will go ahead with a one-year citywide pilot project.
Worse, the nine sups that defied his veto got to explain their reasons, which included slamming the mayor and the police chief for lack of leadership..
Sup. Ross Mirkarimi talked about giving the mayor and Chief of Police plenty to time to take action. When they didn’t, and the Board took the lead, Mirkarimi says he was surprised by the mayor’s veto.
As for SFPD Chief Heather Fong’s hastily announced counter plan, which was made public on Monday, Mirkarimi said, “An acute difference between the two plans is that ours calls for accountability.”
Sup. Bevan Dufty, citing increased incidences of violent crime and inadequate response in the Castro, said “the visible presence of foot patrols is helpful.”
“No one is higher than the chief of police but the chief needs to speak up and to speak clearly without regard for where the chips may fall,” said Dufty, alluding to a lack of morale in the SFPD. “This vote is not offered as a criticism of the Mayor or the Chief. This is the best we can do as a Board right now. Let us rise above that and recognize that we need leadership.”
Sup. Chris Daly couldn’t resist asking how the increased number of officers under the Chief’s plan (44 isntead of the 33 specified in the Board’s plan) “isn’t playing politics.”
Sup. Tom Ammiano wondered what kind of cooperation will be forthcoming, and Sup. Fiona Ma noted that if there was a garbage problem or a flu epidemic, this board would propose a plan, which is why the board reacted to crime wave with foot patrols.
Sup. Michela Alioto-Pier, who along with Sup. Sean Elsbernd voted to uphold the mayor’s veto, said one of the problems was the way the ordinance was written.”
Elsbernd argued that the mayor and police chief should make policing decisions, not the Board of Supervisors.
But Sup. Gerardo Sandoval was upset that SFPD Chief Heather Fong had said that if the Board overrode the mayor’s veto, she didn’t want to disobey the Board’s legislation, but her captains might ignore it.
“We need to be very protective of our roles in this city,” Sandoval told his colleagues.
“To have a Chief of Police say something like that should not go unnoticed.”
Sup. Sophie Maxwell, noting that she probably has the highest incidence of gun violence in her district, recalled walking the precincts this fall and people telling her that they wanted to see the police,
“I have no choice. I have to do this,” said Maxwell of supporting the legislation.
Board Chair Aaron Peskin, who previously voted against the Board’s legislation, but ultimately voted to support it found it ironic that the legislation embraced by the police and the mayor “supports the Board’s idea.”
Sup. Jake McGoldrick found the SFPD’s counter proposal, “a day late, a dollar short.”
“For 5 months, 7 months, 18 months , we were looking for tools, all we got was reaction, not action. But there’s something hopeful about this dialogue.”
After the historic vote, SFPD Chief Heather Fong told the assembled media that she would disagree about their being a morale problem in the department.
Acknowledging that the SFPD is currently 300 officers under its mandated staffing levels, Fong said, “ I believe the captains have to have flexibility.”
Noting that the SFPD’s plan would kick in Nov. 24 and involve 44 officers, Fong added,” I believe the deployment plan will be incompliance with the legislation.”
As for the mayor, it would have been interesting to be a fly on the proverbial wall of his office.

Turning point

It’s amazing what the New York Times can find newsworthy. On a night when progressives in San Francisco racked up an impressive list of victories — and the popular mayor, often described as a rising star in state and national politics, got absolutely walloped — the nation’s newspaper of record led an online report on city politics with this gem: “A bike-riding member of the Board of Supervisors apparently won re-election while his wife was reported to have screamed an epithet at opponents.”
The Times story, by Jesse McKinley, called it “just another night in San Francisco’s iconoclastic politics,” meaning, apparently, that only in this city would a politician ride a bicycle and only here would a politician’s wife use foul language in public.
Please.
For the record: Sarah Low Daly — who watched her husband, Chris, get pummeled mercilessly for weeks by brutal attack ads paid for by, among others, the Golden Gate Restaurant Association — did dismiss “those motherfuckers” with a colorful epithet that no less than the vice president has used on the floor of Congress but that can’t ever appear in the New York Times.
But allow us a little context here.
Daly’s wife had every right to celebrate on election night — and every right to slam the forces that were so unwilling to accept a living wage for local workers, sick pay for employees, requirements that developers pay for affordable housing, and the rest of Supervisor Daly’s progressive agenda, which had made him the subject of a Karl Rove–style smear campaign.
And the Times (as well as the embittered blogger at the San Francisco Sentinel who leveled personal insults at the supervisor’s wife) utterly missed the point of what went on in San Francisco last week.
This was a watershed in city politics, an election that may turn out to have been every bit as important as the 2000 ballot that broke the back of the Brown-Burton machine. It was evidence that district elections work, that downtown money doesn’t always hold the day — and that Mayor Gavin Newsom made a very bad political mistake by aligning himself with some of the most intolerant, unpleasant, and ineffective forces in local politics.
NEWSOM THE LOSER
We ran into Newsom’s press secretary, Peter Ragone, the day after the election and asked him the obvious question: “Not a very good night for the mayor, huh?”
It was a hard point to argue: Newsom put immense political capital into two key races and was embarrassed in both of them. He worked hard for Rob Black, the downtown candidate trying to oust Daly in District 6, showing up at Black’s rallies, walking the streets with him, talking about the importance of the race, and helping him raise funds. His handpicked contender in District 4 was Doug Chan, a former police commissioner. Black lost by 10 percentage points; Chan finished fourth.
And a long string of progressive ballot measures that the mayor had opposed was approved by sizable margins.
Ragone began to spin and dissemble like crazy. “We endorsed [Black and Chan] but didn’t put a lot into it,” he said despite the fact that Newsom spent the last two weekends campaigning for his two favorites.
“The real key for us was Hydra Mendoza, who won [a seat on the school board],” Ragone said.
Yes, Mendoza, who works as the mayor’s education adviser, was elected — but she already had a strong base of support as a former leader of Parents for Public Schools and might very well have won without the mayor’s help.
Besides, if Newsom saw her as a top priority, why did she finish second in a race for three positions, behind Green Party candidate Jane Kim? And how significant will it be to have Mendoza on a school board that now has a solid progressive majority, one she’s not a part of?
Ragone shrugged again, sticking to his line.
But the Mayor’s Office can’t spin away the fact that, as pollster David Binder put it at a postelection event, “I don’t think Newsom had a very good night.”
“It showed that we had a progressive turnout and this is a progressive town,” Binder said.
Boris Delepine, a campaign veteran and Sup. Ross Mirkarimi’s board aide, went even further: “This election ranks up there with the 2000 supervisorial races as far as I’m concerned.”
In other words, progressives battled the downtown interests and won.
The most exciting race was in District 6, where Daly’s expected reelection was thrown into doubt a few weeks ago by some polls and the onslaught of downtown attacks on Daly (which Binder jokingly referred to as “a deforestation project” for all of the negative mailers).
The problem was that most of the material just attempted to savage Daly without really making the case for why Black would be better. That appears to have backfired.
In fact, the assault served to galvanize Daly supporters, who stepped up a vigorous campaign in the final push. “It was very efficient and very effective,” Binder said.
Or as Daly put it to his supporters on election night, “We were under attack…. San Francisco values were under attack, and you responded like nothing before. Five hundred volunteers were in the streets today to say this district is not for sale.”
The message from the Tenderloin, inner Mission, and South of Market was resoundingly clear: with district elections downtown can’t simply buy a seat on the board anymore. Money is powerful — but an organized grassroots campaign can still prevail.
The impact for the mayor is more than just the loss of a potential board ally. Newsom found himself in District 6 working closely with SFSOS — a group that has become so nasty and is so reviled, even two of its key founders, Senator Dianne Feinstein and financier Warren Hellman, have walked away in disgust.
“If all things were equal, I’d just as soon that SFSOS went away,” Hellman told us.
It’s not going to help the mayor’s reputation to be seen in that sort of company.
A HIPPER DUFTY
The District 8 race showed the power of district elections in a different way.
From the start it was going to be tough for Alix Rosenthal, a straight woman, to defeat incumbent supervisor Bevan Dufty, a gay man in what has always been a gay district. But Rosenthal says her candidacy had a clear impact on Dufty — during the late summer and fall, the onetime solid mayoral ally moved a few noticeable steps to the left, supporting Sup. Tom Ammiano’s universal health care bill and voting with the progressives (and against the mayor) for police foot patrols.
“Dufty became a much hipper person after I challenged him,” Rosenthal said.
Dufty told us the challenge made him work harder but had no impact on his votes. “What you saw on foot patrols was an immense amount of frustration with the police chief’s failures to lead the department,” he said. “That had nothing to do with this race.”
Binder pointed out that District 8 has a higher percentage of registered Democrats than any district in the city, and Dufty locked down party support early on. And even though Dufty’s voting record was less progressive than his district, he remains popular. “There are people who think he doesn’t vote the right way on the issues, but nobody thinks he doesn’t try hard,” Binder said.
The District 4 race was not only a test of the power of the mayor’s coattails in a district where Newsom has always been popular. It was also a test of how ranked-choice voting works in complex election demographics.
From early this year, when it became clear that incumbent Fiona Ma was going to the state assembly, Newsom and his allies tapped Chan as the candidate they would promote. That was an odd choice for Newsom, who claims to be a public power supporter: Chan’s law firm has received more than $200,000 in legal fees from Pacific Gas and Electric Co. in just the past two years, and like his alliance with Black in District 6, the Chan endorsement put him on the side of one of the least popular actors on the local political stage.
And in the end, the mayoral support meant little: Chan finished fourth, after Ron Dudum, Ed Jew, and Jaynry Mak.
There was a certain amount of nervousness on election night when Dudum emerged atop the candidate list at the prospect that for the first time in a generation, the board would be without Asian representation. Four Asian candidates appeared to have split the vote, allowing Dudum to win.
But when the ranked-choice voting program was run Nov. 10, that concern evaporated: the new system allowed Asian voters to divide their preferences without risking that sort of vote-split result. When it was all over, Ed Jew emerged the winner.
As Jew told us, “I think it showed that having so many Asians benefited the top Asian vote-getter.”
GREEN DAYS
The school board and community college board races get less press than the top of the ticket, but as citywide contests, they can be even tougher for progressives. And this year the Green Party had some surprising victories.
Jane Kim, a Green, finished top in the balloting — remarkable considering that she didn’t have the endorsement of the Democratic Party. Mendoza came in second, followed by Kim-Shree Maufas. That puts three new members, all of them women of color, on the board and shows that activists frustrated by the votes of longtime incumbent Dan Kelly could defeat someone who until recently was considered a shoo-in for reelection.
Peter Lauterborn, a Kim supporter, was ecstatic about the win. “This is a massive triumph,” he said. “We beat the money and we beat the establishment.”
The same goes for the community college board, where John Rizzo, a Green, appears to have edged out Johnnie Carter, bringing new reform blood to an ossified and often corrupt agency.
Binder attributed the strong finishes by Kim and Maufas to their endorsements by the Guardian, the Democratic Party, and other lefty supporters. He was surprised by Rizzo’s apparent victory (absentees could still change the outcome) but most on the left weren’t. Rizzo had a lot of grassroots support and ran a strong campaign.
Similarly, Mirkarimi — who attended the postelection briefing along with fellow supervisor Daly — didn’t agree with Binder’s line on the school board, noting that the defeat of Kelly and the election of Kim and Maufas were strong endorsements for the stand that the current board lefties — Mark Sanchez, Sarah Lipson, and Eric Mar — have taken against positions by autocratic former superintendent Arlene Ackerman and her downtown backers.

What’s with the pot bill?

Sup. Tom Ammiano has a real simple measure coming to the board that ought to pass unanimously. It’s worked fine in Berkeley for many, many years. It works fine in Seattle, Santa Cruz, and Santa Barbara. And yet, it faces what could be a tight board vote and a mayoral veto. Crazy.

What Ammiano wants to do is make enforcing the marijuana laws the city’s lowest police priority. We’re just talking about possession laws, not sales. The city’s narcotics cops say it won’t be a problem. It will just send a message to the chief and the street patrols that they should worry more about violent crime than about busting someone smoking a joint in the park.

So far, Ammiano can count Sups. Jake McGoldrick, Chris Daly, Ross Mirkarimi, Aaron Peskin, Gerardo Sandoval and himself in favor. That’s six. But Mayor Newsom will probably veto it, so he needs two more.

Bevan Dufty and Sophie Maxwell really ought to get behind this.

Newsom fights veto override

With the Board of Supervisors set to vote Tuesday on the mayor veto of Sup. Ross Mirkarimi’s foot-patrol legislation, the mayor ‘s office has reportedly gone into overdrive to try to ensure his veto will hold .

The math is tough for Mayor Gavin Newsom: Supes Mirkarimi, Chris Daly, Tom Ammiano and Gerardo Sandoval are solidly behind the legislation. That’s four votes. Bevan Dufty, Sophie Maxwell and Fiona Ma all voted for it the first time around, when it passed 7-3, and all have spoken loudly in support of getting the cops out of their cars and into the neighborhoods. Jake McGoldrick was out of town for the vote, but he tells us he’ll side with the majority – which adds up to eight votes, enough to sustain a veto and deal the mayor an embarrassing political setback.

So Newsom is trying hard to get one of the eight to switch sides. Among the plays: Chief Heather Fong held a hastily arranged press conference Monday to announce her own, slightly watered-down foot-patrol plan, in a clear effort to undercut the supes. And we’re told that Senator Dianne Feinstein has been calling board members to lobby against the plan.

McGoldrick and Maxwell both told us that they were planning to vote to override the mayor’s veto, and chided Feinstein for getting involved. “If Feinstein wants to be mayor, she oughta run,” he said.

As for the police’s hastily announced foot patrol plan, Maxwell said, maybe it would be fine, but it was coming too late for her to backpedal.

“The mayor and Heather Fong had ample time. Why did we even get to this point? Because we’ve been asking and asking and finally we came up with legislation. The police have promised things before and didn’t do anything, so this isn’t the time for me to be backpedaling.”

Reached Friday Nov. 10, Dufty told the Guardian that he’s “always supported foot patrols” and has “no confidence” in Fong. But three days later, when Fong was promoting her alternative, all Dufty would say about his vote was, “no comment”

The wildest rumor had Newsom offering to fire Fong if some of the supes would back away from the veto override. The Mayor’s spokesperson, Peter Ragone insisted to us that “There’s no truth to that.” Then his line mysteriously went dead.

So who else could be the swing vote the mayor needs to keep his vanity intact?

Well, on Oct. 24, when the bill was approved, Sean Elsbernd, Michela Alioto-Pier, along with BOS chair Aaron Peskin voted against it.

Elsbernd and Alioto-Pier are known to be solidly in the mayor’s court. But what about Peskin?

Reached Monday night, Peskin wasn’t about to give up his voting plans, but he did say that he found it disingenuous of the mayor to veto the measure on the grounds that the board shouldn’t tell a paramilitary organization what to do, then turn around and say that he, the mayor, was planning to go ahead with foot patrols anyway.

Either way, Tuesday’s 2 pm board meeting will be worth watching.

As Sup. Mirkarimi told the Guardian, “People have told me that the police’s press conference was surreal, strange and desperate. The only reason we’re even in this position is because of an absence of leadership on the part of the chief of police and the mayor. And now they have the audacity to say that their plan is better than ours.
Public safety should never be compromised because of the Mayor’s vanity and the chief’s inaction. It’s an unreal, practically juvenile situation.”

Midnight reflections

The evening started out as a resounding victory for the national Democrats, a train wreck for California Democrats, and a defining night for San Francisco progressives. But the state results are getting a little tigher, and it now appears that Arnold Schwarzenegger’s huge victory won’t drag down every Democrat running for statewide office. John Garamandi may survive to be lieutenant governor (keeping far-right loon Tom McClintock out of that office). Jerry Brown will be the next attorney general, and Bill Lockyer the next treasurer.

And Prop. 90 seems to be sinking.

So all in all, a good night — except for Mayor Gavin Newsom, who must be sitting around wondering why none of the voters seem to want to do what he tells them to.

The near-certain defeat of Rob Black in District Six is a huge deal: It’s proof that a storng progressive with grassroots support and troops on the ground can beat back even a massive political assault by some of the most sophisticated and well-funded forces in the city. It’s also going to mena a few tough years for Newsom, the Golden Gate Restaurant Association, SFSOS, Don Fisher and the rest of the anti-Daly gang: Daly has proven himself an effective politician, and he has never particularly liked it when jerks like these guys try to mess with him.

One of the more interesting aspects of this election was the money that Michela Alioto-Pier spent on ads for a race in which she had no real opposition — big, pricey, video ads on sfgate, for example. What’s that about? Well, part of what it’s about is that Mark Leno is in his last term in the state Assembly, and that seat will open up in two years, which means that in the spring of 2008, a Democratic primary contest will determine the next Assembly member from the east side of San Francisco. Tom Ammiano has already announced his candidacy. Bevan Dufty has loudly proclaimed that he won’t run. Is Alioto-Pier looking at that race?

If so, she’d probably have the support of the mayor — but from the looks of things tonight, that isn’t going to help much.

In fact, from the looks of things, Newsom needs to back away from the SFSOS types and try to make peace with the progressives if he wants to accomplish anything as mayor.

The risk of honest planning

OPINION At the Nov. 1 meeting of the land use committee of the Board of Supervisors, a seemingly straightforward statement of policy will be heard. It simply requires that the city apply its own General Plan guidelines to future development in the eastern neighborhoods.
But the legislation, proposed by Supervisors Sophie Maxwell, Jake McGoldrick, Aaron Peskin, and Tom Ammiano, is creating quite a furor. A senior planning official has testified that if it’s adopted, the entire development boom in the eastern neighborhoods may be halted. The mayor has threatened a veto.
The policy in question calls for city planners to show how they intend to ensure that 64 percent of all new housing development is affordable to moderate-, low-, and very low-income San Franciscans. That’s what the housing element of the master plan says is needed.
Land use development policy lies at the very heart of San Francisco politics. It’s dangerous work for supervisors to attempt to determine that policy, especially if it calls for protection of existing neighborhoods and their residents.
Just ask Supervisor Chris Daly.
Don’t for a minute believe that he is in the fight of his political life because he’s rude, because he doesn’t care about law and order, or because he prefers dirty streets upon which to raise his son. These petty and silly charges mask a far more serious objection: the way his opponents see it, Daly has been too slow in adopting the massive wave of market-rate housing slated for his district and is far too protective of lower-income residents in District 6.
Never mind that since Daly took office some 3,000 units of housing have been built in the South of Market portion of his district alone or that an equal amount wait in the pipeline at the Planning Department. Mayor Gavin Newsom and his market-rate developer allies are simply not satisfied with Daly’s pro–housing development approach — because Daly has sought some balance in that development.
Likewise, the Maxwell resolution calls for plans that will be balanced, contain sustainable development policies, and guarantee a voice for residents against the headlong drive of the current administration to convert the eastern neighborhoods (South of Market, Potrero Hill, the Mission District) into vertical gated communities for Silicon Valley commuters. It states that it shall be the policy of the city that future plans explain not only how they will meet the affordability goals of the housing element but also how they will meet policies of preserving the arts and other productive activities; providing for public transit, pedestrian, and bike rider needs; protecting employment opportunities for current and future residents; and keeping families with children in the city.
There’s a working majority of the Board of Supervisors willing to fight for current neighborhoods and residents and a future that includes them. The battle in District 6 shows that the fight is not without risk. Do the rest of us realize it? SFBG

PG&E’s extreme makeover

Mayor Gavin Newsom called a meeting with Pacific Gas and Electric Co. president Thomas King in July to let the utility chief know that the city intended to pursue public power projects on Treasure Island and Hunters Point.
“It was just to tell him that we’re going to do it,” Newsom spokesperson Peter Ragone said of the meeting. “The mayor thought it was a gentlemanly thing to do.”
King used the occasion to start an aggressive new offensive — and to preview PG&E’s latest political strategy.
In an Aug. 10 letter to Newsom, King promised not to fight the city’s plans in court and pledged to develop a better relationship with the city.
“We know that it was in this spirit of cooperation that you approached us last month, and we want to foster this spirit and forge an even stronger partnership in efforts to protect our environment in the years ahead. That’s why I wanted to respond to your questions and suggestions — and to share with you some ideas of my own,” King wrote, listing one of those ideas as helping the city develop energy from tidal power at the mouth of the bay, which Newsom had recently announced a desire to pursue.
The day after PG&E wrote the letter, Newsom and San Francisco Public Utilities Commission (SFPUC) head Susan Leal announced the city’s intention to supply public power, mostly from clean solar and hydroelectric sources, to the redevelopment project on Parcel A of the former Hunters Point Naval Shipyard, where the politically connected Lennar Corp. (which is also part of the team with the rights to build on Treasure Island) has the contract to build 1,600 new homes.
“What we want to provide is a green community at a rate that meets or beats PG&E,” Leal told the Guardian, noting the history of environmental injustices that have been heaped on the southeast part of town. “We’re very excited about what’s going on at Hunters Point. . . . It’s important that the city do the right thing for that community.”
And just as PG&E was pledging cooperation, it aggressively set out to undermine the city’s plans with competing bids and continued its fiercely adversarial posture in another half-dozen realms in which it must work with the city, battles that have cost San Franciscans millions of dollars.
“This is a competitive world and this is fair game, don’t you think?” PG&E spokesperson Darlene Chiu — who used to be Newsom’s deputy press secretary — told us of company efforts to subvert the public power projects.
Last month PG&E also hired away SFPUC commission secretary Mary Jung, who had been privy to closed-session discussions about various city strategies for dealing with PG&E. Jung, who did not return a call for comment, was required to sign a confidentiality agreement and threatened with criminal charges if she spills city secrets, although city officials acknowledge that would be difficult to prove.
PG&E has also launched a high-profile public relations offensive designed to repackage the utility as a clean and green crusader against global warming and a supporter of community programs such as the mayor’s pet project, SF Connect, to which it contributed $25,000 last month.
“The company has a long and continuing history of fighting against the city rather than working with the city on issues involving municipal power, improved reliability, connecting city facilities, and protecting ratepayers,” Matt Dorsey, a spokesperson for City Attorney Dennis Herrera, told us. “If PG&E wants to demonstrate its good corporate citizenship, it can start by changing the nature of its relationship with the city.”
BIG BUCKS
If anyone from the Bay Area needs a reminder about the big money, bare-knuckle approach PG&E uses when its interests are threatened, they need only look up the road to what’s happening in Sacramento and Yolo counties.
PG&E has so far spent more than $10 million fighting Propositions H and I in Yolo County and Measure L in Sacramento County, which together would allow the Sacramento Municipal Utility District (SMUD) to annex more than 70,000 customers in Davis and surrounding communities.
The PG&E effort has saturated mailboxes and the airwaves with messages that inflate the cost of taking over its transmission lines, imply threats of a drawn-out legal battle, and make bold claims of its being an environmentally friendly utility (for example, including nuclear power in its calculations of how “green” PG&E is).
“They’re trying to spread fear and confusion,” Davis-based public power advocate Dan Berman told us. “A new thing comes out every day. But we keep citing the message of lower rates and better service.”
In fact, SMUD has rates that are about 30 percent lower than PG&E’s and a power portfolio that includes significantly more energy from renewable sources than PG&E uses. Even King’s claim that PG&E is “the leading solar utility in the county, having hooked up more than 12,000 solar-generating customers” is misleading. The number is large because PG&E has the largest customer base in the country, but the solar rebates were state mandated and SMUD inspired and come from ratepayer surcharges.
Still, PG&E justifies its aggressive campaign in Yolo County in terms of warding off a hostile takeover of its customers. For residents there and new customers in San Francisco that the SFPUC wants to serve, PG&E’s Chiu repeats the mantra that “we have an obligation to provide services.”
Yet critics of the company say the campaign is about more than just holding on to those customers. Right now more than a dozen California communities are pushing for public power, most involving community choice aggregation (CCA) — which allows cities to buy power on behalf of citizens, potentially bypassing PG&E.
“That’s one of the reasons they’re pulling out all the stops in Davis, because if this goes through, it will embolden other communities,” Barbara George of Women’s Energy Matters told us.
San Francisco was an early city to pursue CCA, but plans to implement it have moved slowly, and now other communities — including Marin County and the cities of Oakland and Berkeley — are even further along.
“San Francisco is way behind in community choice,” George said. “The mayor is giving PG&E a lot of time to put out its claims to be green in order to fight this.”
Part of that push involves a slick 16-page mailer sent out in August by “The New PG&E” outlining “a proposal for an unprecedented and far-reaching partnership with the city of San Francisco to create the cleanest and greenest city in the nation.”
Sup. Ross Mirkarimi — a longtime public power advocate — is skeptical. “I welcome it, but I don’t buy it,” he said. “Their desire to work with us is typically predicated on the receding of our efforts to pursue public power.”
In fact, King seemed to say as much in his letter to Newsom when he wrote, “We see the investment of time, money and political capital in the public power fight as a distraction from the real need — providing clean, reliable and safe power to San Francisco.”
Chiu denied that there is a quid pro quo here, saying, “It is our intent to help San Francisco become clean and green, whether or not it comes with the city’s blessing.”
Yet Leal said the company seems more interested in stopping public power than going green. Rather than trying to undermine the city’s plans for the area, she questioned, “Why don’t they have the rest of Hunters Point, which are already their customers, be a green community?”
COMPETING WITH PG&E
Lennar is expected to announce in the next week or two whether it will go with public power or PG&E at Hunters Point. “No final decision has been made at this point,” Lennar spokesperson Jason Barnett told us.
Yet it didn’t have to be this way. Lennar’s redevelopment project is being subsidized with public funds that could have been conditioned on public power. Even as late as Oct. 17, when the San Francisco Redevelopment Board agreed to change Lennar’s contract to let the company out of building rental units, public power could have been part of the trade-off. Agency chief Marcia Rosen did not return Guardian calls asking why the public agency didn’t take advantage of this leverage.
For her part, Leal said, “I’m not afraid of competition.” It was a point echoed by Ragone, who said Newsom believes the city shouldn’t be afraid to compete with PG&E on Hunters Point or Treasure Island or to stop a PG&E bid to help develop clean tidal power.
But Mirkarimi doesn’t necessary agree. “Why do they have that right?” he asked, arguing the city shouldn’t let PG&E take control of new energy resources or customers who should be served by public power. “The tentacles of PG&E haven’t receded any less at City Hall and we should always be on our guard.”
Leal and Ragone each acknowledged that competing with PG&E isn’t always a fair fight. After all, in addition to having the resources of nearly 10 million customers paying some of the highest rates in the country, PG&E is also alleged in a lawsuit by the city to have absconded with $4.6 billion in ratepayer money during its 2002 bankruptcy, in what Herrera called “an elaborate corporate shell game.” On Oct. 2, the US Supreme Court denied review of a Ninth Circuit Court of Appeal ruling favoring the city, sending the case back to the trial court to determine just how much PG&E owes ratepayers.
That is just one of several ongoing legal actions between the city and PG&E, including conflicts over the city’s right to power municipal buildings, PG&E’s hindrance of city efforts to create more solar sites, and battles over the interconnection agreement that sets various charges that the city must pay to use PG&E lines.
MONEY IN ACTION
A good example of PG&E tactics occurred during the July 26 meeting of the Metropolitan Transportation Commission, which is overseeing work on the Bay Bridge. As part of that work, a power cable going to Treasure Island needed to be moved, but the Treasure Island Development Authority didn’t have the $3.4 million to do it.
So PG&E executive Kevin Dasso showed up at the MTC meeting with a check made out for that amount, offering to pay for the new cable and thus control the power line through which the SFPUC intends to provide public power to the 10,000 residents who will ultimately live on the island.
“This deal with Treasure Island was really egregious. They came in like a game show host and held up a check to try to stop this baby step toward public power on Treasure Island,” said Sup. Tom Ammiano, who also sits on the MTC board. “It shows PG&E is not asleep at the wheel by any means, and anybody who’s elected is going to need to stay vigilant.”
Ammiano was able to persuade the MTC to loan TIDA the money and preserve the city’s public power option. PG&E officials are blunt about their intentions. Chiu said, “We both want to provide power to Treasure Island.” So officials note the importance of being vigilant when it comes to PG&E.
“There will be other meetings where PG&E will wave around $3.4 million checks,” Leal said. “And at some of those meetings, we won’t be there to stop them.”
So public power advocates are concerned that public officials are letting PG&E rehabilitate its public image. Newsom has recently shared the stage with PG&E executives at a green building conference in San Francisco and the Treasure Island ceremony where Gov. Arnold Schwarzenegger signed the landmark global warming measure that PG&E long opposed before ultimately supporting. Ragone said neither these events nor PG&E’s contribution to SF Connect nor his direct dealings with King indicate any softening of Newsom’s support for public power.
“We’re going to do what’s in the best interests of the city of San Francisco,” Ragone said. “This is the first mayor to support public power, and that hasn’t changed at all.” SFBG

Service Employees International Union president Andy Stern was in San Francisco today to help christen SEIU Local 790’s new digs on Potrero Hill — and to give fiery voice to the prescription for national political reform that he outlines in his new book “A Country That Works: Getting America Back on Track” (all proceeds from which go to SEIU’s political struggles, so go buy one).
He also dropped a bit of a bombshell on the capacity crowd (which included such notables as Mark Leno, Tom Ammiano, Chris Daly, Sophie Maxwell, Dennis Herrera, Phil Ting, and Bob Twomey): 790 head Josie Mooney will be leaving town to work directly for Stern. “I’m so sorry you’re losing her, but it’s a gain for SEIU,” he said to a smattering of gasps. Actually, Mooney tells the Guardian that her departure has been in the works for awhile, but that she plans to stick around for at least a couple more months.
It will be a loss for SF, but to hear Stern outline his vision, Mooney could be a part of something with the potential to rescue the country from self-destruction.

The people’s program

OPINION San Francisco progressives have spent years getting on the political power map. We have achieved amazing victories, such as the 2000 sweep that defeated the Brown machine and ushered in an independent Board of Supervisors. At times we’ve gotten mired in sectarian clashes that have prevented unity around a common vision. However, such obstacles and stumbles have taught us valuable lessons that can be the building blocks for a vibrant people’s movement. To be successful, we progressives need to have a clear vision and to keep asking ourselves questions. What does it mean to be progressive and for progressives to have power? Assuming we all agree that progressive unity is a necessary foundation for social change, what should unity look like today? And if we’re successful at maintaining power, what do we want to look like five and 10 years from now? In the first year following its founding convention and with these questions in mind, the San Francisco Peoples’ Organization (SFPO) has chosen to focus on three issues central to the lives of all San Franciscans — health care, affordable housing, and violence prevention. Over the past year, this fledgling organization has logged a long list of achievements and participated in many exciting causes. Battle for Bayview

It’s been a week since City Attorney Dennis Herrera invalidated the seemingly successful referendum drive challenging the Bayview Hunters Point Redevelopment Plan, and everyone involved is still wondering what’s next.
Can the biggest redevelopment plan in city history just move forward as if more than 33,000 city residents hadn’t signed petitions asking to vote on it? Legally, that’s where the situation now stands. But even Herrera told the Guardian that the legal question he answered is separate from the policy and political questions.
Should the Board of Supervisors hold a hearing to discuss the controversial issues raised by redevelopment and this referendum? Should it consider repealing the plan and allowing a ballot vote, as some supervisors want?
And if each referendum petition must include a thick stack of all related documents, as Herrera’s opinion indicates, won’t that make it prohibitively expensive for a community group to ever challenge such a complex piece of legislation? Have the citizens in effect lost the constitutional right to force a referendum on a redevelopment plan?
“I can’t speak to what the practical effect will be. I can just tell you what the state of the law is,” Herrera told us, noting that referendum case law clearly indicates that the petitioners should have carried the 62-page redevelopment plan and all supporting documents, not simply the ordinance that approved it.
A “TERRIBLE” DECISION
Four supervisors — Chris Daly, Tom Ammiano, Gerardo Sandoval, and Ross Mirkarimi — voted against the plan in May. All have expressed concern about Herrera’s decision, but none have yet called for a hearing.
“Whether you agree or disagree with this opinion on the validity of the redevelopment referendum, it raises some grave concerns that this process — a democratic, grassroots process — was overturned,” Mirkarimi told us. Daly called the decision “terrible.”
Yet given that they need the support of at least two more supervisors to reconsider the plan, Mirkarimi conceded that the next step will probably have to come from a lawsuit by the petitioners, a move referendum coalition leaders Willie Ratcliff and Brian O’Flynn say they intend to pursue if political pressure fails.
“It’s unclear what the next steps are to dislodge this from the legal shackles that knocked it down,” Mirkarimi said. “Something doesn’t smell right, and it’s difficult to trace the odor completely without the courts getting involved.”
But Ratcliff hasn’t given up on forcing a political solution, which he is pushing through his coalition and the San Francisco Bay View newspaper he publishes. The paper last week ran a story on the decision under the hyperbolic headline “City Hall declares war on Bayview Hunters Point.”
“We’re talking to lawyers, but to us the last resort is going to court. We feel we can pull it off politically,” Ratcliff told us. “What this did really was unite this community. If the city will pull this kind of thing, how are we going to have any faith in this plan? We’re going to flex our power…. People are ready to fight now.”
One gauge of Ratcliff’s support in the community will come on the afternoon of Sept. 27, when he will lead a march and rally on the issue. The event is tied to the 40th anniversary of the so-called Hunters Point Uprising, when a teenager was shot by police and the resulting community backlash was violently quelled using National Guard tanks and police sharpshooters.
“With the 40th anniversary of the Hunters Point Uprising of Sept. 27, 1966, only days away, this sounds like a declaration of war against the same people who protested then and are protesting still against police brutality and for jobs, economic equity and the right to develop our own community and control our own destiny,” Ratcliff wrote in a front page editorial.
Ratcliff told us, “We’re going to have a big march out there to show the city that we oppose this plan.”
THE PLAN IS IN EFFECT
Herrera’s opinion on the referendum was requested by Mayor Gavin Newsom, the San Francisco Redevelopment Agency, Board of Supervisors president Aaron Peskin, and Sup. Sophie Maxwell.
Redevelopment Agency director Marcia Rosen told the Guardian that fears of redevelopment stem from how badly it was handled in the Western Addition in the 1960s, but that the agency and the political climate of the city have changed. She said the agency is approaching Bayview–Hunters Point in an incremental, community-based fashion. She said the plan should go forward and will eventually prove the fears are unfounded.
“The plan was adopted by the board and signed into law by the mayor, and there is no further action needed, so the plan is in effect,” she told us.
Maxwell and Peskin each said they’re inclined to just let the redevelopment plan go into effect, although Peskin said, “I’m not going to stop any supervisor from having a hearing on any subject.”
“It’s important to understand that this plan is a living document, so there will be changes and people talking to each other,” Maxwell told us. “It’s certainly not the end of anything.”
She told the Guardian that the referendum campaign used paid signature gatherers, money from a developer from outside the area, and distorted claims about eminent domain and other aspects of the plan — misrepresentations that signers could have checked if the plan was readily available as legally required.
“The democratic process has to be taken seriously, and democracy is not easy,” Maxwell told us. “The decision was about preserving the democratic process, and people need to have facts at their disposal. There has to be a process and there has to be a standard.”
That’s certainly true — and O’Flynn is a contractor who lives in the Marina. But it’s hard to imagine how carrying around thick stacks of paper filled with complex land-use plans would have made a difference. Most signers would never have stopped to take several hours to read it all.
John Matsusaka, president of the Initiative and Referendum Institute at the University of Southern California School of Law, said that referendum case law has been built around a few courts validating actions by civic officials to strike down citizen movements.
“The sad fact is it looked like elected officials are trying to keep measures off the ballot and looking for ways to support that,” Matsusaka told the Guardian. “Preventing the people from voting is really not going to bring harmony to the community.” SFBG

Casting off

Hornblower Yachts assumed control of the ferry service to Alcatraz Island on Sept. 25. As the new crew cast off the dock lines, spurned union workers — some 30-year veterans with the former contractor, Blue and Gold — rallied with supporters at the entrance, asking passengers not to board the boats.
Two union-friendly visitors from Sydney, Australia, ripped up their tickets and demanded refunds. “We don’t agree with what they’re doing to the workers,” one said, while in the background Supervisors Aaron Peskin and Tom Ammiano took turns with the bullhorn, also offering their support to the workers.
“All of our colleagues on the board are not going to stand for it,” Peskin said to the couple hundred laborers gathered on the sidewalk. “We’re going to stand with you and march with you.”
Terry MacRae, CEO of Hornblower, expressed little concern about the boycotting tourists and the rally at his gate. “I suspect there’s plenty more people who want the tickets if they’re not going to use them,” he told the Guardian. Visits to Alcatraz peak this time of year, with a couple thousand people turned away every day when tickets sell out, according to National Park Service spokesperson Rich Wiedeman.
The NPS decision to grant the lucrative, 10-year contract to Hornblower over Blue and Gold has resulted in more than just what some are calling the largest union layoff in San Francisco waterfront history. The story also has an environmental angle as slick as an oil spill and a nasty landlord-tenant tussle.
“The port and I are extremely concerned with how Hornblower has conducted itself,” City Attorney Dennis Herrera told the Guardian, referring to the company’s artful dodge of city and state permitting processes. “They’ve focused more energy on sidestepping public oversight than complying with it.”
Despite infuriating two leading San Francisco institutions — unions and city planners — MacRae has managed thus far to avoid too much of a stir by keeping another critical local constituency off his back with a well-played “green” card.
THE GREEN MACHINE
When NPS put out a request for proposals in 2004, three companies submitted bids for Alcatraz: Red and White, a local charter and bay cruise company that ran the service when it first started in the ’70s; Blue and Gold, which took over Red and White’s boats and unionized crew in 1994; and Hornblower Cruises and Events, which runs charter and dinner boat cruises from five California ports and is a subsidiary of a larger, $30 million company.
When Brian O’Neill, superintendent of the Golden Gate National Recreation Area, announced last year that Hornblower won the bid, union activists immediately challenged the choice. Mayor Gavin Newsom, Peskin, Rep. Nancy Pelosi, and both of California’s US senators expressed concerns about the decision. Neighborhood group Citizens to Save the Waterfront filed suit. Environmentalists, however, were elated.
For the first time since being passed by Congress in 1998, the Concessions Management Act applied to the bid for Alcatraz. In addition to forbidding the Department of the Interior from favoring incumbent contractors, the act also outlined new criteria for awarding contracts that included a mandate to improve environmental quality in national parklands.
“Bluewater Network has been advocating for more than five years for a solar- and wind-powered ferry for San Francisco Bay,” said Teri Schore, a spokesperson for the local environmental group. She added that diesel vessels in the Bay Area account for more pollution than cars and buses combined. “We’ve been talking to every ferry operator on the bay, and we also knew that the Alcatraz contract was up. We thought it was the perfect application.”
Hornblower’s MacRae wrote a provision into his bid that within two years of taking over the Alcatraz service, the company would build and launch a ferry to run on a combination of solar, wind, and diesel power. After one year of testing the vessel, a second would be built within five years.
That — in combination with a plan to make two initial vessels 90 percent more fuel efficient, as well as implement a clean energy shuttle service on the Embarcadero, power the landing facilities with solar panels, purchase green products, and vend healthy snacks — put Hornblower’s bid over the top.
Wiedeman said all bidders are informed that financial feasibility of the company and potential revenue for the government, as well as environmental and sustainability initiatives, were considered. But some criteria were more weighted than others, and Hornblower ranked strongly on all points.
“We’re ecstatic,” Wiedeman said. “We’re looking at higher-quality visitor services from the get-go.”
But some doubt whether the proposed vessels are anywhere close to a reality. MacRae said a final design and marine contractor have not been selected yet, although Solar Sailor’s model BayTri has been touted. A giant solar-arrayed fin provides auxiliary wind and sun power to the trimaran’s diesel engines. No such vessel has ever been built, but the model is based on a smaller solar ferry that services Sydney Harbor in Australia — with a top speed of just seven knots.
The proposed boat is emissions free and could go 12 knots with the aid of the wind, although it would need a push from auxiliary diesel engines to keep up with Alcatraz’s schedule. Boats now run between 15 and 19 knots.
The other concern is that MacRae’s commitment of $5 million for constructing the 600-passenger vessel might not be enough. The San Francisco Water Transit Authority has been looking into a similar vessel carrying no more than 150 passengers that would cost between $6 and $8 million.
“Their requirements for design are different than what mine would be,” MacRae said. “I think it’s possible to do it for $5 million.”
Bluewater Network founder Russell Long worries that the low-budget cap could hurt the vessel’s environmental potential. “We believe that Hornblower may intend to maintain this budget ceiling even if it compromises other aspects of the design, such as best management practices in regard to environmental components,” he wrote in a letter to NPS, urging reconsideration of the contract.
NPS awarded the contract anyway and Bluewater is hoping for the best.
“We will be watchdogging the progress and keeping track of what’s going on. If it doesn’t happen, it will be a huge black eye for the National Park Service, Hornblower, and the city of San Francisco,” Schore said. “At this point we have faith that it’s going to get built, because it’s in the contract.”
However, Hornblower’s snub toward union contracts and dodgy relations with the city suggest that playing by the rules may not be a top priority for the company.
THE PERFECT TYPO
Since 1974, boats to Alcatraz have run from the Pier 39 area of Fisherman’s Wharf, where waiting ticket holders can indulge in the myriad distractions the tourist hub offers.
MacRae launched his new ferry service from Pier 31, half a mile farther south on the Embarcadero, where he currently leases space and operates a charter and dining cruise business.
Pier 31 is little more than a parking lot with a ramp and floating dock, which only sees about 100,000 people a year, far fewer than the 1.3 million annual passengers Alcatraz draws.
MacRae has attractive plans for a complete overhaul of the area, which would include landscaping and sheltered seating, a bookstore, and an informational center. Such alterations would require a thorough run through the city’s planning process, which MacRae told the NPS he won’t be doing until 12 to 18 months from now.
Instead, interim improvements to the lot were planned, which sparked concern from the city that the sudden increase in foot traffic wouldn’t be properly mitigated. That area of the Embarcadero also hosts 250,000 passengers a year from cruise ships docking at adjacent Pier 35. The Port spent close to $200,000 last year controlling that traffic with signage and police officers. The addition of thousands more visitors streaming down the sidewalks seeking passage to Alcatraz could cause gridlock every time a cruise ship docks.
Monique Moyer, executive director of the port, sent repeated letters over the last year to MacRae asking for clarifications about his plans and expressing concern that the change in use of Pier 31 required a review of existing permits.
She wasn’t alone. On July 31, Citizens to Save the Waterfront filed suit against Hornblower, claiming that the amount of activity at Pier 31 would increase twentyfold. “That represents a substantial change in the intensity of use,” Jon Golinger, a representative from the group, told us.
A change in the intensity of use of a waterfront property triggers the need for a complete environmental impact review (EIR) from the Bay Conservation and Development Commission (BCDC), a state agency with jurisdiction over anything within 100 feet of the shoreline. As many city developers know, EIRs can take many months to consider all potential changes to the existing landscape that the applicant would cause. Delays of that sort could have hindered MacRae’s ability to assume ferry service on the contracted date of Sept. 25.
MacRae said the litigation kept him from divulging to the city his proposed plans for upgrades to the pier.
Just days before the lawsuit was to be argued in San Francisco Superior Court on Sept. 6, BCDC executive director Will Travis sent a letter to Moyer stating that Hornblower’s new service and alterations to Pier 31 did not require any new permits.
He cited a typo from Hornblower’s current BCDC-issued permit as an allowance for the increase in passengers. The permit states that the pier may provide “access to the entire bay via vessel for 200,000 to 5000,000 [sic] people/year.”
He footnoted the quote: “There is clearly a typographical error in the 5000,000 number, which is intended to state the maximum anticipated usage of the dock … the correct number is probably either 500,000 or 5,000,000. While it seems reasonable to believe that the correct number is 500,000, the record contains nothing to substantiate this conclusion.”
Travis also relayed that Hornblower plans to use temporary measures that include trailers with port-a-potties, a portable ticket booth, and hollow traffic barriers for guiding traffic and pedestrians on and off the boat.
Herrera told us that this was the first Moyer had heard of what was planned for the lot and there was concern about how other services in the area and traffic on the Embarcadero would be affected, as well as if any structures, signage, and other enhancements would require additional permits. “It certainly would have been nice if they had shared all these plans so the port could conduct the proper environmental review that we all agree is in order,” he said.
In a strongly worded letter to Travis, Herrera wrote that to allow Hornblower to proceed without any environmental review could violate the California Environmental Quality Act (CEQA) and urged the BCDC to “issue an immediate cease and desist order” to prevent the start of service. Herrera also made the salient point that “the later the environmental review process begins, the more bureaucratic and financial momentum there is behind a proposed project, thus providing a strong incentive to ignore environmental concerns that could be dealt with more easily at an early stage of the project.”
On Sept. 7, BCDC commissioners met in closed session at the end of a four-hour meeting and voted to stand by Travis’s argument.
David Owen, a former Peskin aide who’s also a BCDC commissioner, was one of two abstentions to the otherwise unanimous vote. “It was really frustrating, because it seemed like Hornblower did everything in their power to avoid a permit review,” Owen told us. “Now what? We have a CEQA lawsuit and then the Board of Supervisors shuts down the Alcatraz ferry service? They’ve managed to start up service without acquiring a single permit. Kudos to them for strategy.”
Citizens to Save the Waterfront then dropped its lawsuit, feeling it was weakened by the BCDC decision.
“Essentially, now there’s a turf war between Bush’s park service and the Port of San Francisco,” Golinger said. “BCDC tried to avoid getting involved, but the precedent it sets is horrible. A corporation can come in and skirt any planning process.”
UNION TOWN POLITICS
After scoring the Alcatraz bid, Hornblower sought an exemption to the Service Contract Act of 1965 that would have required MacRae to pay equal to or more than what current crew make. But the Department of Labor ruled Sept. 21 against Hornblower. So veteran Blue and Gold crew have added safety to their concerns.
“I’ve made tens of thousands of landings on Alcatraz Island, and now they have captains who have never been there,” Capt. Andy Miller said. For 17 years, Miller has navigated the busy shipping lanes and the constant summer fog against the tugging tide and the sudden slams of inclement weather to bring tourists, park service staff, and supplies to the island.
“No one’s ever gotten hurt. It’s a very tricky place to land a boat. It takes skill and experience that you can’t just hire off the street,” he said.
Miller said he applied for a job with Hornblower but was not interviewed. So far, no captains and only three ticket agents and a deckhand have been hired from Blue and Gold’s former fleet.
“We have a ready workforce,” Master, Mate, and Pilot union spokesperson Veronica Sanchez said. “They’re going to have to be paid the same wages as union workers at Blue and Gold. They don’t want to be a union shop. Why don’t you want to be a union shop on a union waterfront like San Francisco?”
One reason could be concern that it might bump up costs for Hornblower’s other tour operations. “They want us to agree that if we sign up our workers for Alcatraz, that we won’t organize the dining yachts,” Sanchez said. In 1998, the union attempted to organize Hornblower’s dinner cruise operations in San Francisco but didn’t prevail in a supervised election.
MacRae said he’s not opposed to the unions and he’s encouraged the Blue and Gold staff to apply for jobs. “The unionization is the choice of the workers,” he said. “We try to let the employees make the choices. Last time I checked, that’s who the unions represent.”
“We want to make sure we have the best crew,” he said. “Many of the products and guest services we provide aren’t what Blue and Gold do now.” He added that some current employees from the dining cruises have also been shifted to the Alcatraz route.
“I’ve been here 21 years, and we’ve been replaced by busboys and waiters,” said deckhand Robert Estrada, standing with fellow workers outside the gate of the new Alcatraz ferry service.
Estrada said Hornblower’s reliance on part-time, low-wage workers has earned the company the nickname “the Wal-Mart of the Water.” The company’s rapid expansion, from a two-boat Berkeley-based charter to a multinational fleet with government contracts is a similar characteristic.
Blue and Gold spokesperson Alicia Vargas assured us that the remaining ferry services to Alameda, Angel Island, Oakland, Sausalito, Tiburon, and Vallejo will be solvent, but some of the veteran crew who haven’t been laid off yet are worried this is the beginning of the end.
“The public needs to be warned. If funds don’t come from Alcatraz, Blue and Gold could fold,” said David Heran, an International Boatmen’s Union member and deckhand since 1974 who applied to Hornblower but wasn’t hired. “I’m not ready to retire yet, and this wasn’t the way I was expecting it to happen.” SFBG

Discovering the formula

San Francisco has a thing for local businesses. From Chinatown to Hayes Valley, the dozens of distinctive neighborhoods that constitute this city have for the most part maintained their individuality with one-of-a-kind, locally owned places to shop, snack, and seek services.
While many cities and small towns across the country have succumbed to the sprawl and homogeneity of chain stores, some have resisted, even in the face of lawsuits and wily campaigning from megaretailers. Big corporations including Wal-Mart, Home Depot, and Target are combating restrictive municipal legislation with their money, pouring millions into local political races and flying in paid signature gatherers for ballot referenda.
“They’re spending $100 per vote in some cases,” Stacy Mitchell told the Guardian. Mitchell is the author of Big-Box Swindle and a senior researcher for the New Rules Project, a subsidiary of the Institute of Local Self-Reliance, which tracks legislation against formula retail.
“They’re getting mixed results,” she said, which means sometimes the big boys lose, like in the multiyear battle with Inglewood that sent Wal-Mart walking. But more often than not, the formula retailers win.
Take Chicago as a recent example: Mayor Richard Daley overrode city councilors and issued his first veto in 17 years, against legislation that would have required large retailers to pay a living wage to employees. Councilors hoped to trump the mayor with another vote, but at the last minute three councilors switched positions to side with Daley.
“I still don’t understand how it happened,” said SF supervisor Tom Ammiano, who flew into Chicago to speak in favor of the legislation. He told us the city was behind it, though opponents were arguing that low-income people needed the option to work and shop at Wal-Mart and it was discriminatory to not allow the store to move into the city. “They played the race card. It was obvious they were people on [Wal-Mart’s] payroll.”
In the week since the veto, Wal-Mart has already swooped in with several site proposals for the first 20-acre megamart in Chicago. It’s stated an eventual goal of building 20 stores in the Windy City. Could Wal-Mart spite San Francisco just like it did Chicago?
Since 2004, San Francisco has operated with the Formula Retail Ordinance, designed to preserve “the city’s goal of a diverse retail base.” This isn’t an outright ban, but it makes the application and review process more arduous for formula retail. The ordinance defines formula retail as any chain with 11 or more outlets that offer standardized services or mimic one another in decor, architecture, and practices (like Starbucks, the Gap, and Wal-Mart, to name an infamous few).
The relevant legislation, Section 703.3 of the Planning Code, reads like it was penned by a Norman Rockwell acolyte and cites such businesses as generally undesirable, granting neighborhoods the right to be notified of potential chain store proposals. While the legislation allows neighborhoods to create their own stricter legislation, it also grants them the right to accept a chain into the fold, which is a pretty big loophole.
So far, most neighborhoods haven’t been welcoming. A battle in North Beach over Home Depot resulted in an outright ban of all formula retail in the neighborhood. Hayes Valley followed suit. Conditional use permits in western SoMa, Cole Valley, and Divisadero from Haight to Turk add an extra layer of scrutiny to the planning process when a Starbucks or Target want to set up shop. Potrero Hill–Showplace Square is the next in the trend, with a 12-month interim conditional-use period and a more permanent restriction on the way. That restriction was introduced by Sup. Sophie Maxwell, approved by the Land Use and Economic Development Committee, and headed to the full Board of Supervisors for initial approval Sept. 19 after Guardian press time.
Maxwell’s legislation could become moot this November if voters approve Proposition G, the Small Business Protection Act, which would extend conditional-use permitting to the entire city, making any proposal from a chain store subject to public hearings and an arduous Environmental Impact Review at the expense of the applicant, not the city.
Dozens of counties and municipalities have enacted similar ordinances around the country in response to the track records of megaretailers. Public criticism is mounting against corporations such as Wal-Mart and Home Depot for drawing the shopping masses by reducing prices to quash smaller competitors and for pulling profits out of communities instead of keeping them local, as small businesses tend to do.
But the chain stores aren’t just rolling over.
“It’s happening in enough places that it’s reached a point where they’re feeling nervous about how it’s affecting their growth,” Mitchell said about the retail giants. Her organization has been assisting communities for several years in drafting legislation against formula retail and is seeing some of that legislation undercut by voracious chain stores. Wal-Mart, the most notorious foe, dumps thousands of dollars into local election races. The tactic is especially evident in California.
“Wal-Mart spends more in California than anywhere,” said Nu Wexler, spokesperson for Wal-Mart Watch, a Washington-based organization with hawk eyes on the company. “They have active lobbying in all 50 states, but California is a particularly important market for them.”
He attributes that to the state’s status as the sixth-largest economy in the world. In 2002, Wal-Mart promised to open 40 supercenters in the state within four to six years. As of October 2005, only six had been opened. “They’re fighting expansion battles all over the country, but they’re having an especially difficult time in California,” Wexler said. Inglewood, Turlock, and Hercules have all recently dodged Wal-Mart.
But several other cities have not, despite protective measures, and in the last year 12 more supercenters have opened in California, bringing the grand total to 19.
Contra Costa County, apropos of no immediate threat, passed a 2003 ordinance prohibiting “big box” stores over 90,000 square feet. In response, Wal-Mart dumped more than $1.5 million campaigning for a measure overriding the ordinance on the next available ballot. In 2004, the ordinance was overturned by 54 percent of voters.
Four years of fighting in Rosemead resulted in two city council shake-ups, with a recall election of two council members set to be decided this week; a possible Brown Act violation when city officials approved a permit for Wal-Mart during a meeting when it wasn’t on the agenda; and multiple lawsuits from both sides. Wal-Mart spent $200,000 campaigning and dropped another $100,000 in local charities to spread some good cheer. It worked: doors opened at a new supercenter Sept. 18.
Last August, a Wal-Mart opened just across the bay in Oakland even though the city already had a ban on big-box retail larger than 2.5 acres. Spurning the city’s provincial laws, Wal-Mart found real estate regulated by the Port of Oakland — which, similar to San Francisco’s port, is outside the city’s jurisdiction and not subject to local ordinances.
“It was passed in a backroom deal with the port before the city could have any public hearings,” said Adam Gold, a spokesperson from Just Cause Oakland, a local group that opposed the store. “It made it difficult to resist it. It had already been approved.”
At the state level, Governor Arnold Schwarzenegger recently vetoed Senate Bill 1414, introduced by San Francisco’s state senator Carol Migden, which would have required employers with more than 10,000 workers to put 8 percent of total wages toward health care. Not a surprise: Wal-Mart’s Walton family dropped more than half a million dollars into electing the governor, with a most timely donation of $250,000 last year on the very day he vetoed legislation aimed at Wal-Mart that would have required businesses to disclose when employees use public health care services.
Two other bills, SB1523, requiring environmental impact reports and public hearings for the construction of stores larger than 100,000 square feet, and SB1818, allowing cities to recover legal fees when sued by big-box retailers, sailed through the legislature but are currently festering on the governor’s desk.
Is it all enough to protect San Francisco? Can the city keep mom and pop on the corners and resist the commercialism that has made a city like Emeryville the mall that it is today?
Maxwell, who pushed the recent legislation for Showplace Square and Potrero Hill, hopes so. “I’d rather have the position of them on the offense than the defense,” she said of potential retail applicants. When asked if the city codes are strict enough, she said, “If not, I’d be willing to put forth the legislation that is.”
As for the idea of Wal-Mart coming to town, the District 10 supervisor was nothing if not firm: “No, no way. Not in San Francisco.” SFBG

Thousands of fantastically perverse revelers (most of them gay) will flood San Francisco for the Folsom Street Leather Fair on Sept. 23, ensuring that every cranny of the city brims with wanton copulation — which really is the way it should always be in our famously lewd burg, no? Too bad that for the other 364 days of the year, good ol’ slutty San Francisco is considered by erotic tourists to be one of the most prudish cities in the world.
Unlike other civic dens of iniquity, San Francisco has no gay bathhouses, no sleazy back rooms in bars (well, none that the cops have sniffed out yet), and a dwindling amount of mischief in the bushes. This sorry state of affairs is due partly to the advent of Internet hookup sites in 1996 (thanks, AOL) and partly to the break in gay traditions caused by the loss of a generation to AIDS. But mostly it’s due to the “sex panic” of 1984, when well-meaning gay activists looking to protect gay men from their supposedly unsafe urges convinced the city to ban all bathhouses and enforce rules that separated public sex from any sort of alcohol consumption and unmonitorable activity. Gay folks would just have to go to Berkeley to get wet and have sex. That may have made BART more fun, but for many it seemed like a forced expulsion from SF’s sexual garden by Big Brother.
In 1996, gay city supervisor Tom Ammiano tried to get the baths reopened by proposing a set of HIV-risk-reducing regulations that included no private rooms, no alcohol consumption, safer-sex education materials and condoms on-site, brighter lighting levels, and the presence of staff monitors to ensure against unsafe activity. Pretty oddly, the city adopted most of his proposed regulations — leading to the rise of today’s slick, commercially licensed sex clubs — but kept the bathhouse ban. This means that it’s now OK to pay to have sex with strangers in a public setting, but if there’s any kind of water running other than from a broken toilet, you’re in trouble.
Whether or not gay men in San Francisco should be left to their own sexual devices is still a matter of polemical debate. Or is it? Not many people seem to talk about it anymore. But you can’t stop the party. From 1989, when the last bathhouse was closed by a city lawsuit, to 1997, when San Francisco began using commercial licenses to approve sex clubs, a vibrant sexual underground ruled. Often subject to raids by police, the underground included anonymous-encounter mainstays like Blow Buddies and Eros, both of which opened on a members-only basis in hopes of circumventing any legal trouble. It also included less formal play spaces like the Church of Phallic Worship and Orgasm, naughty nooks that live on only in legend.
This dark period — or golden age — of underground sex clubs (and with the lights off, it was probably both) has largely been forgotten. But exciting tales of the past still issue forth from it, and with the current revival of ’70s bathhouse nostalgia, it’s interesting to note that bathhouse culture extended well into the ’80s — yep, folks were dropping towel to Paula Abdul’s “Cold Hearted Snake” — and poured out into the underground sex clubs of the early ’90s before being sucked toward the Ethernet of now. We asked a few of the scene’s regular, anonymous players for their memories of some clubs of the time.
NIGHT GALLERY, A.K.A. MIKE’S PARTY
“You’d ring a little bell at this house a few doors down from the Powerhouse — tingaling-aling — and they’d open the door, and at the top of this long flight of thickly carpeted stairs, there’d be this guy sitting in a chair who would say in this flat, uncommitted voice, ‘Welcome to my party. Friends tend to chip in $5 to help cover costs. My roommate’s in the kitchen if you want to check your stuff.’ That was Mike, and it was funny he said roommate, because you know no one really lived there.
“At the top of the stairs was this long hallway full of amateur erotic art — not like Tom of Finland, more like a horny Grandma Moses. I stole a drawing that I think was supposed to be of an S-M twink but more resembled a Christmas pixie in irons. I don’t remember much about the sex rooms, except there was a shoddy maze in the back and a sign that said ‘No talking in the fun zone.’
“In the kitchen there was a beer keg and a big aluminum bowl of shiny-looking Cheez-Its that I could just never bring myself to snack on. I knew where those Cheez-Its had been. There was also this kind of ‘Your Own Carnival Hot Dog’ maker that was more like a filthy aquarium with gray franks in tepid hot dog water that no queen would touch — despite the metal tongs provided ‘for your protection.’”
TROUBLE
“Conga-line dance-floor fucking was what I remember most about this place. Which is pretty darn difficult if you take varying heights into consideration. Trouble was a totally anything goes kind of club — after-hours alcohol served, a big dance floor with professional-looking lighting, out-in-the-open nasty sex. Like Studio 54 if Liza was a go-go whore and, you know, a sexy guy. It was in SoMa around Folsom and, I think, First.
“There were dark rooms and a maze upstairs — it was in a big warehouse space with a high ceiling. It got raided three or four times before they finally shut it down. It only lasted like eight months. During the raids the cops weren’t all, like, ‘Let’s get the faggots,’ they were more, like, bored, flashing their lights around and saying in a polite voice, ‘Please leave — you have to go now,’ like they were ushers and we had overstayed our welcome at the opera.”
THE BLACK HOUSE
“The Black House was freakin’ scary. It was this old Victorian off Castro painted completely black. I had just moved here — in 1994. I was 23 and thought the Black House was where Anton LaVey used to live and they had Satanic rituals there, but really it was just a bunch of naked guys fooling around in the basement. I don’t remember exactly where it was, but somehow my drunk feet took me there after the bars closed.
“Mostly the guys were cute in a hustler sort of way — this was when tweakers left the house to get laid. But there would be some letches. One guy followed me around telling everyone I looked like an Etruscan statue. I got really embarrassed and had to leave and go look up Etruscan. One time the hot young guy doing coat check took out his teeth to blow some other guy. I wonder whatever happened to him.”
ORGASM
“Orgasm was across the street from Endup on Sixth, so you could just stumble there and have sex at any time of the day or night, it seemed. There was this huge stage, 10 feet deep, where they had live sex shows and some really crusty Goodwill couches. One time I tricked with a guy who asked me to drop him off at Orgasm, and the minute he got there, he shed his clothes and got up onstage for a show. Where did he get the energy?
“Like most other clubs, it was in a warehouselike space, very minimal. There was a door guy and another guy inside with a clipboard, but that was just to look official — there was never anything on the clipboard. The space was divided by curtains for ‘privacy’ and had a long overhead shelf with candles on it, which added atmosphere to the ‘lovemaking.’ There were turntables, and I remember it was around the time that Boy George came out with ‘Generations of Love,’ which was a surprisingly good record.”
CHURCH OF PHALLIC WORSHIP
“I think the Church in SoMa used to have ads in the back of the Bay Area Reporter, but everyone just seemed to know about it. It had a real rough, underground feel. I don’t know if it was officially religiously affiliated, but maybe they got free parking out of it. They served beer after hours — it was like a one-stop shopping hub of gay socializing: backyard barbecue, glory holes, music, the works.
“It was run by a Santa Claus–type character called Father Frank, and every time you called the info line, he’d answer the phone by reciting a homoerotic limerick in this hilariously effeminate voice, like Rona Barrett on 33 1/3. It was a cross between a house and a warehouse — pretty big, but it could get way too overcrowded. What was so great was that it went all night, yet no one seemed like they were on speed. Everyone was just drunk and having a great time.”
1808 CLUB
“This was a big house down by Guerrero and Market near where the LGBT Center is now. I remember this huge door with a tiny window you had to knock on, like it was a speakeasy in Communist Czechoslovakia. This totally hot bald guy would answer, and I’d kind of be intimidated because he was so muscular. Years later he became my personal trainer at Gold’s Gym.
“The place was painted all black on the inside and was on two levels, one overlooking the other. Balconesque, as the French would put it. There were these little cubbyholes all over the place that two people could fit in, and maybe you could squeeze in three on occasion. On weekends it was packed. It was cheap too: $5 for the whole night, and they’d stamp your hand so you could get in and out. I didn’t go too much, because it was in my neighborhood and I like being a little incognito. That’s a little more classy.” SFBG

Referendum struck down

San Francisco City Attorney Dennis Herrera has invalidated the referendum that challenged the Bayview Hunter’s Point Redevelopment Plan, ruling that it didn’t include all the documents that the more than 33,000 people who signed it needed to make an informed decision.
“They didn’t have the redevelopment plan itself for voters to evaluate,” Herrera spokesperson Matt Dorsey told the Guardian just after the decision was released Sept. 19.
But Willie Ratcliff, the Bayview Newspaper publisher who helped funded and coordinate the referendum drive, told the Guardian that they carefully consulted with both city officials and their attorneys to ensure the documents complied with state law.
“We expected the city would try to look for a way out and of course we’re going to fight them in court,” Ratcliff said.
The Elections Department had ruled Sept. 13 that the referendum had enough valid signatures to stop the plan. The Board of Supervisors then had the option of repealing it or submitting it to a popular vote. But board clerk Gloria Young is now required by law to invalidate the referendum and only a judge can now make it valid.
The board, which approved the plan on a 7-<\d>4 vote in May (with supervisors Tom Ammiano, Chris Daly, Ross Mirkarimi, and Gerardo Sandoval in dissent), could still act independently to repeal the plan and submit it to a vote, as recall campaign coordinator Brian O’Flynn is urging. “The will of the voters should be respected,” he told us
The plan would put about 1,500 acres in Bayview-<\d>Hunters Point under San Francisco Redevelopment Agency control, set new development standards, and collect all property tax increases into a fund that would go toward projects in the community. Opponents fear the plan would displace current residents and gentrify the area.

Ammiano’s coup

Matier and Ross reported Sunday what everyone on the San Francisco left knew was coming: Sup. Tom Ammiano is formally announcing his run for State Assembly in 2008. Aside from the fact that Ammiano would make an excellent state Assembly member, here’s the political brilliance of the move: The only other person remotely rumored to be considering running for that seat is Sup. Chris Daly. In fact, behind the scenes, a lot of local players have been saying that state Sen. Carole Migden would suport Daly, even in a run against Ammiano.

But Daly is up for re-election this fall, and obviously can’t announce a run for Assembly (if he’s even interested) until well after November. That means for months to come, Ammiano will be the only game in town — and he can start lining up endorsements. According to M&R, Migden has formally endorsed Ammiano, as has the incumbent in that seat, Mark Leno.

Daly would also be an excellent member of the state Assembly — but if he wants to run, he’s already way behind and will have the challenging task of explaining why he’s better than Ammiano, particularly when they generally agree on all the issues.

Fiber vs. wi-fi

San Francisco’s top officials want to get the city more directly involved in creating a better telecommunications infrastructure. Their goal is to overcome the digital divide and pump up the city’s overall bandwidth without waiting for the private sector to maybe get around to it.
But Mayor Gavin Newsom and the San Francisco Board of Supervisors have focused on distinctly different pathways to the whiz-bang future they both envision. And the agency in charge of getting the city there — the Department of Telecommunications and Information Services (DTIS) — has moved the mayor’s big idea at high speed while inching the board’s plan along at a snail’s pace.
Newsom first proposed a citywide wireless Internet system that would be free for the city and its residents during his State of the City speech Oct. 21, 2004. At the time it was just an ambitious promise that seemed to languish, until late last summer when the DTIS issued a request for information to a variety of high-tech firms.
By the end of 2005 the city had settled on trying to negotiate a deal with a partnership between Google and Earthlink to build the system, which they will finance largely with revenue from targeted advertising and users who pay a fee for faster connections. City officials are still in negotiations with Earthlink and expect to have a proposal ready for the board to consider by the end of the year.
Yet three weeks before Newsom announced his intention to pursue wireless, Sup. Tom Ammiano and a coalition of public interest nonprofits announced a plan to have the city build and run a municipal broadband system by laying fiber-optic lines as city officials open up the streets for the planned sewer system replacement and other projects.
It was an ambitious idea never realized by a big city in the United States, one that would put tremendous bandwidth directly under city control and be a potential source of millions of dollars in annual revenue and cost savings.
Now, almost two years after the Board of Supervisors ordered a study on the plan, the DTIS has finally hired consultants — the Maryland-based Columbia Telecommunications Corp. (CTC), which works exclusively on fiber-optic projects for public agencies. The first draft of the plan is expected to be available for public comment by the end of the year.
“We consider both the wireless and fiber projects to be important,” Brian Roberts, the DTIS senior policy analyst for both projects, told the Guardian. “But we thought wireless would be something that could be accomplished in a relatively short timeline.”
Roberts and others involved in the projects say the two ventures aren’t mutually exclusive — that any wireless system would actually get a big technological boost from city-owned fiber, San Franciscans will likely use up whatever bandwidth they can get, and wireless reaches mobile users in a way that fiber can’t.
But activists of various stripes have catalogued a number of concerns with Newsom’s wireless plan: the secretive nature of the early negotiations, private sector control over the system, the mayor’s relationship with the Google founders (who proposed the idea in the first place), the exposure of residents to increasingly sophisticated advertising campaigns, shortcomings in serving the poor and truly breaching the digital divide, and problems associated with wireless technology (mainly involving reliability, health, and capacity concerns).
The fact that these two plans are coming before the Board of Supervisors at the same time — which Roberts said is purely coincidental — is likely to renew the age-old debate about privatization and public interest.
Should the city be pursuing the public-private partnerships favored by Newsom, which can be delivered to voters quickly and at seemingly little cost to government? Or should it be focusing on long-term strategies that will give the city more control over the resources its citizens need — from electricity to information technology — without having to depend on the profit-driven private sector?
The DTIS announced the commencement of the municipal broadband study during a little-noticed public meeting Aug. 15, during which a dozen or so of the most committed activists, representatives for Comcast (which aggressively opposes most municipal broadband initiatives), and downtown building owners heard from the consultants.
CTC founder and principal analyst Joanne Howis outlined the scope of her firm’s study and sang the praises of what’s known in her industry as Fiber to the Premises (FTTP), noting that it’s the most reliable, high-capacity broadband technology and that the price of delivering it to people’s homes has fallen tremendously in recent years, to the point where it’s the best all-around broadband delivery system.
“Fiber is better, and wholly controlled fiber is better still,” she said. “That’s an article of faith with us.”
Later, activists pushed the point on wireless versus fiber. “Fiber can do many of the things wireless can’t do, but it can’t go mobile,” Howis said, also noting that fiber is essential to a reliable public safety system. “Fiber and wireless speak to different needs and are used in different ways.”
But when asked what’s better for residential users, she said, “Anyone who can have fiber or wireless to their homes will choose fiber.”
“Unless it’s free,” Roberts interjected.
But public interest media advocates like Media Alliance say the city is going about this backward. The group has been critical of the city’s wireless plans and has studied the potential for municipal fiber, arguing in the just-released report “Is Publicly Owned Information Infrastructure a Wise Public Investment for San Francisco?” that the city could pay for its investment within five years and make $2 million per year thereafter by leasing space on the network. So all sides are happy to see the fiber study finally moving forward.
“We met with a lot of resistance to the study, but the good thing was we got the money for the study from the Mayor’s Office,” Ammiano told the Guardian. “While I’m disappointed that it’s taken so long, I’m heartened that it’s now moving.”
Meanwhile, Google last week got a free citywide wireless system up and running in its native Mountain View. The system is faster than the free service it intends to offer to San Franciscans, who will have to pay a bit more if they want anything faster than the targeted average speed of 300 kilobytes per second.
“Google is putting up a lot of money to make the service free in San Francisco,” Chris Sacca, who is heading up the project for Google, told the Guardian. He estimated that the company has spent over $1 million to develop the San Francisco plan.
While the fiber study will analyze the benefits to the city itself, Sacca said the wireless proposal began with consumer demand. “At Google we start with the end-user problem, then work backward from there.” SFBG

Vote to impeach

EDITORIAL Mainstream media reporters and pundits, as well as our cynical colleagues at the SF Weekly and the rest of their corporate alt-weekly chain, love to bash the San Francisco Board of Supervisors and the city councils of other Bay Area cities for passing resolutions on big questions like war, human rights, or impeachment.
We don’t share that view. Resolutions take almost no time or effort to pass, yet they are important barometers of popular political sentiment, tools that are particularly important given how both major political parties have shown more willingness to listen to their corporate backers than their lowly constituents. People need avenues to make their voices heard without the filters imposed by the leadership of the Democratic and Republican parties.
That’s why we’re happy that citizens in both San Francisco and Berkeley will get a chance to vote this November on the question of whether Congress should initiate impeachment proceedings against President George Bush and Vice President Dick Cheney for their many high crimes: fraudulently leading the United States into war, illegally spying on Americans, torturing enemies, claiming unconstitutional executive power, vioutf8g binding treaties, and engaging in war crimes and profiteering, among others.
Berkeley and San Francisco will be the first major American cities to allow a popular vote on this question. The Guardian in January was one of the first publications in the country to lay out in detail the impeachable crimes of the Bush administration (“The Case for Impeachment,” 1/25/06), joining a chorus of activists, scholars, and legal experts who say this is the only way to slow the country’s slide into empire and penetrate the Bush administration’s veil of secrecy.
Our congressional representatives have been terrible on this issue, showing more concern with seeking partisan advantage than upholding the Constitution. Rep. Nancy Pelosi has said the Democrats won’t pursue impeachment even if the party retakes Congress this fall. But maybe they’ll listen to the people directly telling them that we want Congress to finally launch a serious investigation into the many crimes perpetrated by the Bush administration.
This is a vote that the world wants to see us take. We commend the Berkeley City Council and SF supervisors Chris Daly, Ross Mirkarimi, Tom Ammiano, and Jake McGoldrick for giving the people this opportunity to be heard on the most important issue of our time. SFBG

The case against the JROTC

OPINION Make no bones about it: the Junior Reserve Officer Training Corps (JROTC) is a program of the US Department of Defense. Its purpose is clear: to recruit high school students into the military. Two years ago, 59 percent of San Franciscans demonstrated their disapproval of that sort of recruiting by supporting Proposition I. It’s time for the Board of Education to follow the wishes of those voters and phase out the JROTC in favor of a nonmilitary program.
On Aug. 22, it’s very likely that the San Francisco school board will do just that. Before the board is a proposal to not only ease out the JROTC but also form a blue-ribbon panel to find an alternative.
It’s not a new idea. In the mid-1990s, a similar board proposal failed by a 4–3 vote. This time the vote will probably be reversed. Phasing out the JROTC in San Francisco should be a breeze. Two years ago, a measure to put the city on record as wanting to bring the troops home from Iraq passed by 64 percent. Since Sept. 11, hundreds of thousands of San Franciscans have protested the wars in the Middle East. There’s no other city in this country with so much antiwar activity. So what’s the problem?
It’s the kids. The JROTC has successfully organized scores of young people (mostly white and Asian) to attend school board meetings to testify about the benefits of the program. A few LGBT kids have said that the local chapter of the JROTC does not discriminate, which JROTC officials confirm. What they don’t talk about is the fact that a queer kid can’t be out (or found out) in the armed forces. Since 1994, when “Don’t Ask, Don’t Tell” was first implemented, more than 11,182 queers have received the boot. There are also beatings and harassment to contend with in the military if you’re suspected of being queer. It’s not a pretty picture.
The JROTC doesn’t tell kids that a lot of what the recruiters promise is a lie — the kids might not get the educational benefits and job training promised in all the promotional materials. As Z Magazine reported (August 2005), 57 percent of military personnel receive absolutely no educational benefits. What’s more, only 12 percent of men and 6 percent of women who have served in the military ever use job skills obtained from their service. As Lucinda Marshall noted in an Aug. 24, 2005, article on ZNet, “According to the Veterans Administration, veterans earn less, make up 1/3 of homeless men and 20% of the nation’s prison population.” Be all that you can be?
Education was never the point of the military, of course. As former secretary of defense Dick Cheney once said, “The reason to have a military is to be prepared to fight and win wars…. It’s not a social welfare agency, it’s not a jobs program.”
Let’s not sell our youth short. Or make them fodder for oil wars. Or subject them to antiqueer discrimination and hate crimes. Let’s give them all the skills they need to make their lives the best they can be. We can do that without the military. SFBG
