The BART Board is clueless

EDITORIAL The senseless and horrifying murder of four Oakland police officers March 21 has cast a pall over law enforcement agencies all over the Bay Area. It’s renewed calls for a federal ban on assault weapons, which is long overdue. (It’s also reminded us why a daily newspaper can be so valuable — Chronicle coverage of the incident, with numerous reporters quickly responding, is the kind of journalism that won’t happen if the city’s only major daily dies.)

Unfortunately, it’s also taken the focus away from other police issues, and while we mourn the four deaths of veteran officers who were killed trying to do their jobs, we can’t stop trying to solve the problems of cops who lack training, supervision, and oversight.

In that context, there is no other way to say this: the BART Board of Directors is as clueless as any governmental organization we’ve seen since the administration of George W. Bush declared victory in Iraq.

In the past 17 years, BART police officers have improperly shot and killed three people. There have been hundreds of complaints of unnecessary use of force. Most recently, a BART cop shot a young man point blank, and video recordings of the incident have created widespread anger and unrest.

Yet there is still nothing resembling a civilian oversight agency for that 200-member force — and the BART Board members are once again asking the public to trust them to take care of the situation.

Assembly Member Tom Ammiano and state Sen. Leland Yee are sponsoring state legislation that would force the BART Board to establish a San Francisco-style office of citizen complaints to handle all civilian complaints about BART police officer conduct. There are ways Assembly Bill 312 can be improved, and Ammiano, who is guiding the measure through its first legislative hearings, is open to productive suggestions. But when the BART Board sent a delegation to meet with Ammiano, the transit directors had only one basic message: they said AB 312 was "too prescriptive" — that is, it sought to set clear, strong rules for what BART has to do. BART would rather that the Legislature make some broad suggestions but let the folks who run the district shape the final outcome.

That’s simply unacceptable. BART has had plenty of time to address this problem, and plenty of notice that something is terribly wrong. In 1992 a BART cop shot and killed 20-year-old Jerold Hall near the Hayward Station, firing a shotgun into the back of Hall’s head as the unarmed young man was walking away. The shooting violated BART’s own police procedures and the rules that govern the use of deadly force at nearly every modern law enforcement agency in America — but the officer received no disciplinary action, not even a reprimand. In 2001 another BART cop shot and killed a mentally ill man who was lying naked on the ground. Again, BART declared the shooting perfectly okay. With that kind of lack of oversight, it’s not surprising that Oscar Grant was shot and killed early New Year’s Day — the BART police have never been held accountable for improper killings.

And the BART Board has never done a damn thing about it.

Now there is a special board committee that’s supposed to study police oversight. It has never held a single public meeting. Board member Tom Radulovich, who represents San Francisco and sits on the committee, told us there will be public meetings soon. But so far, all that the four-member panel has done is hold private discussions with local interest groups, with no public notice. We would argue that those meetings were a clear violation of the spirit, if not the letter, of the Brown Act, which mandates that government agencies hold open meetings. But more than that, the closed meetings suggest that the BART Board has no understanding of the public anger and impatience with its 17-year record of failing to keep its police force in line.

Ammiano and Yee should refuse to compromise the basic premise of their bill. The state of California, which gave BART the right to create a police force, must now mandate exactly how that force will be managed. The BART Board had its chance and failed. We simply can’t trust that ineffective agency to get it right this time. * *

The BART police committee mess

In the wake of the shooting of Oscar Grant, which was captured on videotape and inflamed the community, and 17 years after the shooting of Jerrold Hall, which was reported only by me and roundly ignored by BART’s establishment, the BART Board finally agreed to set up a subcommittee to look at police oversight and procedures. But if you haven’t heard much from that panel, it’s not surprising — Sweet Melissa reported last week that the police oversight committee hadn’t yet held any public meetings.

But wait — it gets even better.

I called Linton Johnson, the BART spokesperson, and asked him if Melissa had it right. “No, not at all,” he said. “The committee meets in public all the time.” When would that be? “At the regular BART Board meetings, every other Tuesday and Thursday.” Huh? I admit, I haven’t been to a BART Board meeting in a while, but it turns out, according to Johnson, that the committess all meet simultaneously with the full board. “The board goes into recess then reconvenes to hear reports from the various committees,” he explained.

That’s odd, I told him — no other agency I know of does that. Why BART? Well, he explained, the board members only get paid “their miserable $1,000” when they attend full meetings, and most of them didn’t want to take the time to come to an additional meeting on a different day.

Jesus, that’s lame. The San Francisco School Board members go to weekly meetings AND committee meetings AND spend about 30 hours a week working on school stuff, and they get $500 a MONTH. The BART Board members make four times as much and are too lazy to get to more than two meetings?

Wait — there’s more. Melissa told me that Linton’s story “was completely different from what he told me. He said he didn’t even know when the next meeting was.” And more: Quintin Mecke, who works for Assemblymember Tom Ammiano, was actually at the last BART Board meeting, and he told me that the police oversight committee reported that they had, in fact, been meeting on their own, with various community leaders and experts on police oversight — but they hadn’t given any public notice of those meetings and the sessions had been private.

I called BART Board member Tom Radulovich, who is on the committee, and he told me that “we will start having public meetings soon.” But he said he worried that public sessions might not be as productive — “I’ve been to a lot of public hearings at CIty Hall, and people say things differently in public than they do in private. We want to have conversations, and public hearings are not always conversations.”

Sure — but private meetings aren’t good, either. That’s why the state’s Brown Act requires most public agencies to do most of their work in public. How is BART getting away with this? Well, Johnson says, the folks at BART HQ have conveniently decided that the police oversight committee is actually just a subcommitee, and since it has four members, and there are nine BART Board members, a meeting of the subcommittee doesn’t include a quorum of BART Board members and thus doens’t require public notice.

Give me a fucking break.

I like Tom Radulovich, and he’s one of the very few decent members of a generally miserable board, but he’s missing the point here. Legal or not, it looks terrible for this committee to be holding secret meetings. This nonsense has to end.

SF pot raid clouds federal drug policies

Yesterday’s federal raid on the locally permitted SoMa medical marijuana dispensary Emmalyn’s California Cannabis Clinic caused confusion about what local growers can expect from an Obama Administration that recently announced that it would no longer be conducting such raids.

Drug Enforcement Administration officials are saying little about the raid, which came on a Wednesday, the day Emmalyn’s gives out free marijuana to poor patients. But the DEA seemed to be trying to dance around the conflict with the public statement, “Based on our investigation, we believe there are not only violations of federal law, but state law as well.”

Assembly member Tom Ammiano, whose Assembly Bill 390 would decriminalize even recreational uses of marijuana, told the Guardian that the raid sends a troubling message and could indicate internal conflicts within the administration.

“It’s a little vigilante for me. They’re obviously try to flex their muscles, probably to have a showdown with the Obama Administration,” Ammiano said of the DEA. “The dispensaries are going to be in the crosshairs of this struggle.”

We can’t trust the BART Board

So the BART Board is looking at whether BART cops should carry handguns. Nice. They don’t do too well with shotguns, either.

Seriously, what that department needs, more than anything, is civilian oversight, and if this study is about deflecting that, then it’s a worthless idea.

Assembly member Tom Ammiano has a bill that would force the BART Board to create a San Francisco-style oversight agency.

Ideally, the state Legislature wouldn’t have to spend time on this issue; the BART Board would just do it. But the BART Board is made up largely of lame, lazy hacks who have ignored this issue for years. I called Tom Radulovich, one of the few decent members of that board, and he told me he’d support the bill, but wanted it amended. “It’s too prescriptive,” he said. “We all agree on what the elements should be, but I’m not sure locking a variety of the San Francisco Office of Citizen Complaints into state law is the best idea.”

Radulovich had some suggestions — audits, ways to measure how well the system is working, etc. — which all make sense. And I’m sure there are all sorts of ways that Ammiano’s bill can be improved. But here’s the bottom line:

The final measure that comes out of Sacramento MUST be prescriptive. It must outline in very clear detail exactly what the BART Board has to do. The very fact that Ammiano is pushing this issue, and that the BART Board hasn’t already established an effective oversight plan, is all the evidence you need that it simply won’t happen without a firm state mandate.

I like the OCC model; it’s as imperfect as any government system, and a weak or compromised director and a police chief who refuses to cooperate can undermine its effectiveness. But it does the right thing, which is to take all internal affairs-type civilian complaints out of the hands of the police.

I’m sure Ammiano would be more than open to amendments, but if the BART Board members try to argue that the state should simply set broad guidelines and let them handle the details themselves, the answer is simple:

You’ve had more than 20 years to do that, and you’ve failed, and at least three people who ought to be alive today are dead because of that. No way we’re trusting you to get it right this time.

Ma leads fight against Tibet resolution

San Francisco Assembly member Fiona Ma led the battle in Sacramento to derail a pro-Tibet resolution, leaving some activists scratching their heads.

Sure, the measure was sponsored by a Republican, Sam Blakeslee, R-San Luis Obispo, and sure, that made some Democrats nervous. But frankly, it wasn’t that big a deal — the Assembly passed a virtually identical resolution last year, honoring the Dalai Lama. The U.S. Congress has passed stronger pro-Tibet resolutions.

Ma, however, insisted it would harm U.S.-China relations:

“[The Obama] administration has been proactively engaging in diplomacy with China including human rights,” Ma said. “I believe we shouldn’t undermine the proactive efforts being done at the federal level.”

I asked her by email why it was fine to pass a pro-Tibet resolution last year, but not okay this year. Her response:

Last year was a different time and situation. I asked to send this Resolution back to committee for further review. I’m proposing amendments so will let you know what happens.

Tom Ammiano, who also represents San Francisco, scoffed at the move to send the measure to the Rules Committee, which typically means a bill is dead. “I wanted it voted on on the floor,” he told me. “It had the votes to pass.”

A new tax on smut?

Heads up: There’s a move in Sacramento to put a new tax on “adult entertainment.” (Scroll down and read the second part of the press release). A couple of thoughts:

1. I’m a tax-and-spend liberal, and I have no problems in general with taxes on services.

2. Still, this is kind of funky. It’s not clear yet how the bill will define “adult entertainment.” As demimonde and labor activist Princess Pandora puts it:

Do they charge Britney Spears concerts? She dances all sexy, including “pelvic undulations,” which are considered a simulated sex act by ABC and can get a club fined/shut down. What about the ballet? Those tights don’t leave much to the imagination. Do you think women love Barishnikov for his dancing? Girlfriend, please! If I do porn, but wear flowers in my hair, and maybe recite some crappy poetry, can I call it “performance art” and avoid the tax?

3. We don’t charge sales tax on newspapers and magazines. When does a magazine become porn, and thus taxable? One nude on the cover (that would include much of the alternative press in America)? What about the Sports Illustrated swimsuit issue? (I know, it’s pretty lame, but Playboy’s pretty lame, too).

4. I don’t love the connection this bill makes, if even implictly, between “adult entertainment” and domestic violence. Don’t want to open a can of worms here, but I think there’s a lot more DV that can be traced to the Super Bowl than to most innocent smut.

I’ve put in a call to Assembly member Torrico’s office, and they promised to get back to me. I’ll keep you posted.

UPDATE: Jeff Barbosa, a spokesperson for Torrico, just called me. He said the bill is a “work in progress” and that they still haven’t defined what “adult entertainment” will be. But he said right now they’re using Penal Code Section 313 as a working definition.

Here’s the language:

“Harmful matter” means matter, taken as a whole, which to the
average person, applying contemporary statewide standards, appeals to
the prurient interest, and is matter which, taken as a whole,
depicts or describes in a patently offensive way sexual conduct and
which, taken as a whole, lacks serious literary, artistic, political,
or scientific value for minors.

Ooh, I can see this creating a lot of problems.

I wonder: Perhaps the Assembly could take a page from Tom Ammiano’s pot bill, and legalize prositution, then tax it. Make sense to me.

Ammiano’s struggle on pot, BART cops

Assemblymember Tom Ammiano is finding that the moderate Democrats up in Sacramento can be just as annoying as the Republicans. Take two of his top priorities right now, a bill to force the BART police to adopt civilian oversight, and a measure to legalize marijuana.

The BART police measure is going to the Public Safety Committee, chaired by Jose Solorio, a moderate Democrat from Santa Ana.

Some of Ammiano’s Democratic colleagues are nervous about even bringing the bill up for a hearing. “They say is an incendiary situation, that even talking about this could cause riots. I’ve told them the opposite — that if there’s any whisper that we’re screwing around with this bill up here, that when the trouble is going to start.”

The pot bill is scheduled for a hearing in Public Safety March 31, and again, Ammiano worries that “they’re not taking it seriously.” They should — all the signs around the coutnry are changing. The federal government is going to stop chasing after medical pot clinics.
This is a way for the state, which is facing even more serious red ink than the governor admits, to bring in a billion dollars or so in taxes — not to mention the amount saved by not wasting police time (and jail space) on marijuana.

I got a call from Sen. Mark Leno, who was frustrated by dealing with what he labeled “religious zealots” during yesterday’s Prop. 8 hearing and rally, and wanted to talk about my reporting on how churches bused in conservative Christians from former Soviet-bloc countries whose immigration was sponsored by Sacramento area churchgoers.

The problem isn’t with religion. After all, Leno noted that the California Council of Churches opposed Prop. 8 and the stripping away of same-sex marriage rights. People are entitled to their beliefs. The problem is with religious fundamentalists who want government and laws to conform to their religious values. Several Prop. 8 supporters told me they were trying to implement God’s will, and a couple even said that God told them to be there.

“These folks are theocrats. They want a theocracy,” Leno said. “We’re spending tens of billions of dollars fighting theocracies around the world, because they’re antithetical to the concept of democracy.”
Assembly member Tom Ammiano agreed, telling us that he’s drawing a line in dealing with these hateful religious zealots. He said someone from the Catholic League sitting near him in the hearing tried to be chummy with him, and he told him, “I don’t want to talk to you.”

Ammiano was also irritated by attorney Kenneth Starr, the darling of the religious right who argued their case yesterday, whose main argument Ammiano summarized this way, “I felt like he was saying, what are these slaves complaining about? They’ve got a house to sleep in. What, they want clothes now?”

Blaming the system

The Grand Sheraton Hotel in downtown Sacramento was buzzing Feb. 24 as some 400 conference-goers representing myriad geographies and political perspectives gathered in one room to tackle an enormous question: should California’s constitution get an overhaul?

Hosted by the Bay Area Council, a San Francisco-based business group, the summit introduced the idea of staging a statewide constitutional convention that would grant Californians the opportunity to make major revisions to the state constitution and streamline the government reform process.

The council hopes to place a measure on the ballot as early as November 2010 to ask voters if a convention should be called. If the effort gets a green light, it would mark the first time in 130 years that a meeting of this kind was convened in California.

The state’s government is dysfunctional, Sacramento Bee columnist Dan Walters opined during the summit. Full of stakeholders with disparate viewpoints who are too often unwilling to collaborate, he said, the Legislature either tends to roll out "unworkable monstrosities" or have its efforts stalled by a small number of representatives who disagree with the majority. "The problem isn’t really which party is in charge," he said. "It’s the fundamental structure of the government."

The summit attracted diverse interests ranging from Chevron Corp., an icon of big business in the Bay Area, to the Courage Campaign, a left-leaning political organization cast in the mold of Moveon.org. Despite being divided on other issues, all parties seemed to be in agreement on the main point that California’s government is desperately in need of a fix.

"I think of the government in California as being like the Winchester House — you keep adding rooms, but there are no corridors," Sen. Mark DeSaulnier (D-Concord) joked at the summit, referring to a historic mansion in San Jose renowned for its monstrous size and complete lack of a floor plan.

The idea for holding a convention was first floated last summer, when Bay Area Council President and CEO Jim Wunderman published an editorial in the San Francisco Chronicle titled "California Government Has Failed Us." Wunderman struck a nerve, and organizations such as Common Cause and the League of Women Voters signed up to partner with the business group to launch the constitutional convention effort. Clamor for government reform got louder still in recent weeks, as a disapproving public witnessed legislators sink into a debacle over the budget deal.

An arduous budget debate further intensified when it came to extracting the last vote needed to achieve the required two-thirds majority. The Democratic majority wound up negotiating with Sen. Abel Maldonado (R-Santa Maria), who turned his vote into leverage to force concessions on his own demands. Maldonado was able to single-handedly eliminate a proposed 12-cent increase on the gas tax, and he stipulated that an initiative be placed on the May ballot for an open primary.

"The budget was held hostage to right-wing ideology when the people of the state were demanding a real solution to a real problem," says Lenny Goldberg, executive director of the California Tax Reform Association and the owner of a lobbying firm. "For example, the only way they could get the votes was to give away huge corporate loopholes."

The lesson learned? "We have tied ourselves in knots with the two-thirds vote requirement," declared Lt. Gov. John Garamendi, a moderate Democrat and gubernatorial candidate, spurring a round of applause at the summit. Garamendi called for "majority rule, plain and simple, on every issue." He also suggested extended term limits, and transitioning to a 120-member unicameral legislature to allow representatives to better represent smaller districts.

Other ideas for reform that got bandied about during the summit included reinventing election procedures and considering approaches such as instant-runoff voting, establishing proportional representation, changing the number of signatures needed to place an initiative on the ballot, and establishing an automatic review process for state agencies.

In order to hold a convention, California voters would have to approve two separate ballot initiatives. The first would create an amendment to the current constitution allowing voters to call the convention, while the second would call the actual convention. Both questions could be put to voters on the same ballot, according to the Bay Area Council. Any changes made to the constitution would then have to be ratified by voters.

The process of calling a convention is clear enough, but questions abound on how to proceed from there. For example, how would convention delegates be selected? How many would attend? How would the organizers ensure inclusiveness across ethnic, gender, and economic boundaries? Would the convention open up the entire constitution to debate, or would parties agree to narrow the scope to a few key issues? How would the convention itself escape the same gridlock that critics say has rendered the Legislature dysfunctional?

Without hammering out the fine points, it’s hard to know whether the enthusiasm exhibited at the summit could survive the nitty-gritty details of actually going through with a convention. It’s also too early to say whether progressives could emerge from such a process satisfied with the results.

Assemblymember Tom Ammiano adopted a wait-and-see attitude toward the constitutional convention. "I wouldn’t tell you at this point I’m enthusiastic about it because it could be too much blah-blah and not enough action," he told the Guardian. "I do definitely support budget reform — I’m going to make that a priority — and really want to look at the budget infrastructure, certainly the two-thirds majority. I think we need to deliberate on it and make certain that it wouldn’t have any unintended consequences."

Sen. Mark Leno shared Ammiano’s view that the two-thirds majority requirement tops the list of problems. "I think we could take some modest but profound steps before we open up an entire potential Pandora’s box," he said of the convention idea. "I don’t wish to dampen the spirits of our friends at the Bay Area Council. Their intentions are very good. But should it go forward, the devil will be in the details."

Goldberg took a similar stance. "The biggest problem is the two-thirds vote requirement for taxes and a budget," he told the Guardian. "If a constitutional convention is the way that issue gets resolved, that’s positive. But the question is, how long is that going to take? How are they going to do it? There are so many unanswered questions that I would say, if that’s the only way to deal with the two-thirds vote, let’s do it."

Robert Cruickshank, public policy director at the Courage Campaign and a blogger with the political Web site Calitics.com, said he feels confident that a convention is a worthwhile pursuit for progressives. His organization conducted a poll of its membership to gauge whether there was progressive support for the idea, he said, and results showed that 92 percent of respondents supported it.

For his part, Wunderman emphasized the convention as a tool that could be used by voters rather than elected officials in Sacramento. "I’m excited about changing the game, changing the rules," he told the Guardian. "And I’m more confident than ever that if you lead Californians to revise their constitution, once they see it, they’ll know what they have to do, and they’ll do it. And the fact that it was them that did it will give rise to support for the product."

The Rainy Day Fund — a better way?

I get the concerns about Sup. Chris Daly’s proposal to amend the city’s Rainy Day Fund. But in the end, there’s probably a way to make it work that’s better than a lot of unpleasant alternatives.

The Rainy Day Fund was Tom Ammiano’s gift to San Francisco, a brilliant piece of legislation that has saved the public schools and will save hundreds of jobs and critical public services this year. The bill ensures that the city sets aside some of its money in good years, so there’s something to draw on in really bad times.

And these are really bad times.

Last year, money from the Rainy Day Fund saved the school district from laying off hundreds of teachers. In the wake of the governor’s assault on public education, the local schools will need another allocation to prevent this year’s disaster.

The way the bill works, the city can take up to half the money in the fund in dire times, and the schools can get up to 25%. That means there’s no temptation to raid all the money at one time.
If we hadn’t had the fund – and there were plenty of people who didn’t think it was a good idea when Ammiano introduced it – we’d be in way worse shape now.

What Daly wants to do – with the support of city employee unions – is amend the legislation to allow the supervisors, by majority vote, to take as much of the money as they need to preserve health and human services if the city’s deficit exceeds $250 million.

Ammiano is against that; he sees it as an attack on the idea of the fund, which is supposed to ease budget problems not just in one year but for the future as well. Sup. David Campos, who I respect and trust, is also against the Daly measure. “This year is bad, but next year is going to be bad, too,” he said.

And I get that, and I get that labor wants to preserve services (and jobs) right now, because once those jobs and services go away, it’s really hard to get them back.

So let’s recognize that both sides have a point, neither side is bad or evil, there are good progressives who disagree on this – and take a look at the numbers.

New push for Harvey Milk Day

Last year, Gov. Arnold Schwarzenegger vetoed legislation by Mark Leno (then an Assembly member and now a Senator) to establish May 22 as “Harvey Milk Day,” honoring the late San Francisco supervisor’s birthday with a “day of special significance” marking his causes and encouraging schools to teach children about his life.
Tomorrow, Leno will try again with Senate Bill 572, and this time he’s appealing with Schwarzenegger’s Hollywood side by tapping Sean Penn, who just won the Best Actor Academy Award for his title role in “Milk.” Leno and Penn will appear at 11 a.m. tomorrow at Tosca Cafe (242 Columbus) and will be joined by Assembly member Tom Ammiano, Geoff Kors of Equality California, activist Cleve Jones (a character in Milk and consultant to the film), and Milk’s nephew Stuart MIlk.
Mindful of not pushing too far in tough fiscal times, Milk Day would not be an official holiday from work, but it would finally recognize a civil rights leader who was ahead of his time.

Might the wasteful U.S. war on marijuana be coming to an end? That possible light at the end of this long dark tunnel was sparked by U.S. Attorney General Eric Holder yesterday when he said the federal government would no longer raid medical marijuana facilities in the 14 states where voters have legalized weed for medical uses.

That announcement comes just days after California Assembly member Tom Ammiano introduced a bill that would decriminalize and tax marijuana, even pot consumed for strictly recreational reasons by healthy Californians. Advocates are hailing the twin announcements as a refreshing change from the ridiculously intolerant rhetoric that has characterized the national narcotics debate for decades.

SF health care, for the record

I’m glad to see that our new president is giving San Francisco credit for taking a big step forward toward universal health care. But this is a bit misleading:

“Instead of talking about health care, mayors like Gavin Newsom in San Francisco have been ensuring that those in need receive it,” [Obama] said.

Actually, Sup. Tom Ammiano and his colleagues developed Healthy San Francisco. Newsom joined in later, after the hard work was done. Ammiano has been very good about letting Newsom take some of the glory, but it’s a bit annoying for the rest of us to see a guy who has never been good at developing and implementing his own programs get so much praise for someone else’s work.

New push to legalize drugs

At a time when the recession is forcing tax increases and deep cuts in government spending — and when California is being ordered by federal judges to substantially reduce its prison population — this would seem to be the ideal moment to end the costly, wasteful war on drugs.
That’s the hope of Assembly member Tom Ammiano, who tells the Guardian that next week he will introduce legislation to decriminalize and tax marijuana, a move that might instantly turn a huge drain on the public treasury (at least $17 billion a year nationally, and closer to $50 billion once related costs are figured in) into what saves the state from financial ruin, given that pot is California’s number one cash crop.
“This is long overdue,” said Ammiano, who will work on the measure with John Vasconcellos, who represented the Silicon Valley in the Legislature for 38 years and was the last legislator to really carry the banner for legalizing marijuana. In fact, Ammiano says he’s basically reintroducing Vasconcellos’s bill from 2004, which went nowhere.
Meanwhile, another former member of the Board of Supervisors, Carol Ruth Silver, this week resigned as director of SF’s Prisoner Legal Services program out of frustration with the large number of nonviolent drug users in the San Francisco jail, joining a new Law Enforcement Against Prohibition campaign for the legalization of all drugs.
As she told the Guardian, “The jail is full of people who should not be there.”

The budget deal taht came down early this morning is ugly. One Republican, Sen. Abel Maldonado, was able to hijack the process and make some crazy demands. He singlehandly forced the Democrats to get rid of a 12 cent increase in the gas tax, costing the state billions. Then he forced the Democrats to accept a statewide ballot measure for an open primary system, which the progressives hate. (Open primaries allow Republicans to vote for Democrats who are more moderate; Nancy Pelosi went to Congress in an open primary, beating then-Sup. Harry Britt. Britt won among the Democrats, but Pelosi got enough Republican votes to give her the job.) Assemblymember Tom Ammiano told me the budget package was bad enough but he simply couldn’t swallow the open primary measure. “A lot of us didn’t vote for it,” he said. But it passed anyway, with the simple majority it needed, and that (along with a long list of other awful stuff) bought Malonado’s vote.

Ammiano’s statement on the deal reflects what a lot of progessives think:

No one is happy about the service cuts, layoffs and tax increases that were a necessary part of this plan. In voting for this budget, I want to acknowledge that we have made painful cuts to vital human services that serve the poor and the elderly as well as deep reductions in education spending for our schools. We did so with great reluctance in the hope that some of these cuts will be restored through the recently passed federal stimulus bill.

The respite we have after closing this budget shortfall is short-lived and there is a long, difficult road ahead to restore our fiscal stability. The approved plan did take a step in that direction by including a rainy day fund that will help us offset budget cuts in future years

Brian at Calitics has a nice line here about Maldonado’s hypocrisy. And there’s a nice analysis here of what the package really looks like.

State Sen. Mark Leno told me that part of the problem was that the Republican caucus was a mess — the GOP leader, Dave Codgill of Modesto, was part of the budget negotiations, but when he agreed to accept tax increases, many of his colleagues refused to go along. Leno says Codgill was a “profile in courage” — he knew that voting for tax hikes would harm, and possibly doom, his career as a Republican in a conservative district, but he did what had to be done to keep the state solvent. And when the GOP lawmakers balked, Leno announced on the floor that the should either follow their leader or find a new one. A few hours later, that’s what happened — Codgill was removed as minority leader and replaced with an even-more-ardent anti-tax guy, Sen. Dennis Hollingsworth of Riverside County, who wanted to scrap the entire budget and start over with a “no-new-taxes” plan. That was just pure political posturing — it was never going to happen.

What a mess. I’m with Jean Ross of the California Budget Project, who says that , “If this year’s budget negotiations don’t increase public support for reducing the vote requirement for approval of a budget and tax increases, it is not clear what will.”
