Ask a musician

There is a riddle wrapped in the central enigma of Stephen Kijak’s 2007 film Scott Walker: 30 Century Man. That riddle is Julian Cope. Dozens of musicians, including David Bowie and Brian Eno, listen to the elusive Walker’s music on-camera and testify to its impact. But Cope, who effectively revived Walker’s career and laid the foundation for his current cult legend status by compiling the ultrarare 1981 retrospective, Fire Escape in the Sky: The Godlike Genius of Scott Walker (Zoo), only communicates with Kijak via an e-mail that the filmmaker weaves into the web of commentary. In a movie dedicated to slowly revealing a famously mysterious figure, Cope cameos as an invisible man.

Cope’s role in 30 Century Man got me thinking about his position within popular music, a train of thought that led to the subject of musicians as creators and guardians of musical canons. In the ’80s, I’d bought albums by Cope’s group, the Teardrop Explodes, and early solo recordings such as 1984’s fox-y Fried (Polygram, 1984), where he wears a turtle shell and nothing else on the cover. Some close friends were so devoted to Cope that they named their first son Julian, but my interest in him fizzled. Checking back decades later, I soon realized that through writing, he’d generated new waves of enthusiasm around the "supreme Magic & Power" of Krautrock (via the self-published 1995 tome Krautrocksampler [Head Heritage]) and Japanese psychedelia (via Japrocksampler, published in 2007 by Bloomsbury). His Web site, www.headheritage.co.uk, spotlights a favorite album each month and uses list-making as an opportunity to uncover unique tracks like Bloodrock’s 1970 death-rattle ambulance anthem "D.O.A." — a song one of my high school teachers used to introduce poetry to a class of burnouts.

Deemed a "rock musician, author, antiquary, musicologist, and poet" by Wikipedia, Cope is likely the most visionary canon creator or canon editor among those musicians given to the practice. The man who once sang a love song to Leila Khaled is now more ambivalent about terrorism — and about Cluster, even if Krautrocksampler helped remake their reputation. But his musical guides might also be sonic versions of the ancient megaliths he’s also studied and written about at length. Before I even began reading Cope’s notes on rock’s various formations, they’d put a spell on me — in other words, they influenced my listening habits. He’s like a benevolent musical version of Dr. Julian Karswell, the rune master in Jacques Tourneur’s 1959 film Night of the Demon.

Bob Stanley of Saint Etienne is a musician-canonist whose aesthetic has fewer aspirations to deep authority than Cope’s, but one that roves more freely. While Devendra Banhart is often credited with the rediscovery of pastoral folk priestess Vashti Bunyan, it was Stanley who first introduced her recordings to new generations: she appears on Dream Babes, Volume 5: Folkrock ‘n’ Faithfull (RPM), a 2003 entry in a ’60s girl-pop series he began in 1994, as well as his 2004 compilation, Gather in the Mushrooms: British Acid-Folk Underground, 1968-1974 (Castle Music). A keen expert regarding cult figures such as Joe Meek, Stanley recently traced Bon Iver’s current fringe hero status back to Thomas Chatterton in a piece for the UK Guardian. Saint Etienne’s revelatory 2004 contribution to the mix series The Trip alone has turned me on to the Left Banke, Gloria Scott’s neglected 1974 disco classic What Am I Gonna Do? (Casablanca, 1974) and its arranger, Gene Page, and Serge Gainsbourg’s 1970 Cannabis soundtrack (Universal, 2003).

The musician as critic, if not canonist, has a long tradition in the United Kingdom: Stanley wrote for Melody Maker before forming Saint Etienne, for example. Cope might be viewed as the butch authorial corollary of Morrissey, who has waved the banner for such alternate history icons as Sparks, Klaus Nomi, and Twinkle, the latter the subject of a Stanley RPM compilation. The rock star- or DJ-as-curator trend also manifests via compilation series such as Fabric and festivals like All Tomorrow’s Parties. When My Bloody Valentine curated the 2008 New York installment of ATP, to some degree the musician-as-canonist idea came full circle, as the most evasive band from the mid-to-late-’80s reappeared amid a flurry of reissues from the era. Since the beginning of the presidential campaign, Americans have been bombarded with one big concept summed up in one little word: change.

It was Barack Obama’s slogan from day one and represented many people’s hope for the future, an idea that so appeals to beleaguered Americans that the Republicans eventually adopted it as well. Both parties recognized that the country would have to make big adjustments to salvage the economy, environment, schools, and health care system.

They each cited factors that point to the big changes that are coming — but they didn’t mention a huge one that has been bearing down on our species for nearly 5,200 years: the colossal transformation of solar system and our collective psyche that the ancient Mayans and their modern day supporters believe will take place Dec. 21, 2012, the day the Mayan calendar comes to an abrupt end.

Erick Gonzalez, founder and spiritual leader of Earth Peoples United, a nonprofit organization that works to bridge indigenous values with modern society, says the event will deeply disturb our minds and bodies here on earth. Nearly 300 people from around the world gathered Oct. 31-Nov. 2 during a 2012 conference at Fort Mason Center.

Some enthusiasts predict an apocalypse, while others foresee a shift in human awareness. Yet they all believe that big change is coming.

The Mayan calendar was developed by ancient astronomers who concluded that Dec. 21 was the sun’s birthday, noting that the winter solstice marked the beginning of the sun’s return from around the world.

Gonzalez, who has been studying Mayan culture for 33 years, says Dec. 21, 2012 will be a monumental birthday for our sun, when it will shift to the dead center of the Milky Way galaxy, on the galactic equator, for the first time.

The Mayans believed this was the precise spot where the sun — and all life — was created. Followers of the ancient theory claim the Milky Way will give birth to a new sun and a new galactic cycle on this day, marking the beginning of our world’s transformation.

"For the Maya, this is like the stroke of midnight on New Year’s Eve," said philosopher Roderick Marling, a Tantric yoga teacher who has spent the last 36 years researching yoga meditation and expanding consciousness, in addition to writing numerous papers on religion, mythology, history, and archeology. "The galactic clock will be set at zero point, and a new processional cycle will begin," he said.

As our planets shift overhead, believers say our awareness of the Earth, political issues, and each other will also change. Conference co-organizer Christian Voltaire says many of the changes in 2012 will be tangible, such as revising our current financial model or switching to alternative fuels. He points to former presidential candidate Ron Paul, who advocated for extreme change in monetary policy — abolishing the IRS and the Federal Reserve, for example — and Obama, who has pushed for transforming the economy with green jobs. "They’re at least conscious of the fact that something has to change," he says. "And, as we’ve been told by our prophesies, change is coming."

But skeptics have their doubts. Wouldn’t we be pushing for green energy anyway? And how could the shifting planets cause the financial meltdown — or even the actual meltdown of our polar ice caps? University of Florida anthropologist Susan Gillespie says the theory is a media myth and nothing more. Susan Milbrath, author of Star Gods of the Maya: Astronomy in Art, Folklore, and Calendars and curator of Latin American art and archaeology at the Florida Museum of Natural History, believes it’s unlikely the Mayans could have predicted such events.

Believers remain undeterred. Last Gasp Books employee and conference attendee Eliza Strack says her 2012 obsession started as an innocent topic of conversation many years ago. She believes alternate realms of existence and multiple dimensions of time could collide, allowing us to access our past, present, and future in one moment. "We spend a quarter of our lives in a dream state where alternate realities are playing themselves out," Strack says. Gonzalez backs her up, arguing that the alignment of the sun in 2012 will create a powerful magnetic force, and human protons and electronic will react to it.

Lifelong Mayan researcher John Major Jenkins, who has written several books on 2012, brings up the possibility of the sun inverting the earth’s magnetic fields. But according to Vincent H. Malmström, professor emeritus of geography at Dartmouth College, there’s no hard evidence to support Strack’s claim. Besides, how could a magnetic pull bring our dreamlike realities to life? Malmström writes in his paper The Astronomical Insignificance of Maya Date (www.dartmouth.edu/~izapa/M-32.pdf): "It would seem that Jenkins has advanced our understanding of the Maya from the sublime to the ridiculous."

Although we have four years before the astral shift, Voltaire says it’s crucial to hold 2012 conventions now. "The weekend before the election carries a vibration of anticipation of the future. We wanted to connect with that." The Southern Californian didn’t know much about the 2012 theory before last March, but he says he’s constantly alert and keeps a subtle ear out.

"I kept hearing the subject of 2012 in my consciousness — at events, on the radio, at yoga class," he says. "Everyone was talking about it." After making a few phone calls, he partnered with 2012 author and filmmaker Jay Weidner, a native Oregonian who has been studying the subject for nearly 20 years. Sponsored by Weidner’s company Sacred Mysteries Live, they organized their first convention in Hollywood in March 2008 and were blown away by the response.

Their conference last weekend was even bigger. With interactive panels and community circles, participants could share their ideas about 2012. Voltaire and Weidner say it represents something different for everyone: change, chaos — even beauty. In the midst of it all, the organizers premiered 2012-themed films and documentaries that filmmakers submitted along with an entry fee of — $20.12.

The conference also offered critical analyses of some related prophecies: the Mayans, Tibetan Buddhists, Incas, and the mysterious Cross of Hendaye. They lived in different times, and had different notions about the events that would take place around 2012. Conference organizers say Inca texts prophesized "a world turned upside-down" around that year, while Tibetan Buddhists predicted the mythical city of Shanballad would be constructed at the end of the current era.

Voltaire says the Cross of Hendaye — a 400-year-old monument in the coastal town of Hendaye, France — holds the key to the paradigm. The cross was first described in the 1926 book The Mystery of the Cathedrals, written by an alchemist named Fulcanelli. In 1995, before learning of the 2012 stories, Weidner was hooked on this book. He worked for years to decipher the messages behind the cross, deconstructing a Latin inscription carved into its top, and finally claims to have discovered its meaning: "It represents a world crisis that will end this time period.

There’s exactly one presidential term left before the end of this time period, which has witnessed everything from financial crises to homelessness to global warming. But will a new era end the problems of the current one? It’s hard to imagine how thousands of San Francisco’s poorest residents will acquire homes, or how our ozone layer will suddenly thicken.

After rifling through more books, Weidner says he discovered another secret behind the cross: that the Earth’s greatest changes will take place between 1992 and 2012. During that time so far, we’ve seen the birth the Internet, economic globalization and overextension, mass extinctions and global warming, terrorism and imperial hubris, exploding populations and rising discontent, and the end of the age of oil coming into sight. Then again, 20 years is a long time and life moves fast these days, with or without a mystical cross.

Nevertheless, since his supposed discoveries, Weidner has written two books and one film about the Cross of Hendaye’s secrets. In addition to a simpler belief that attributes a natural, geological pattern to these changes, three other prophecies predict some version of disaster or shift around 2012. Weidner admits this could be an incredible coincidence, but he thinks we should be aware of today’s experiences anyway. "There’s no doubt this is one of the most incredible time periods in human history."

While no one knows what will go down Dec. 21, 2012, Strack likes to put a positive spin on the brewing events. She wonders if 2013 will bring sweet-smelling city air, friendly neighbors, and tricycles for old folks to ride to the grocery store. After all, who believes that a shift in consciousness would be a bad thing?

Many followers even look forward to the date and equate it with the second coming of Christ, when they will be blessed with knowledge and euphoria. "Those are the happy thoughts," Strack says. "Yin-yang that shit and you find the darkest, most terrifying possibilities." She says she has had multiple apocalyptic dreams, leading her to ponder World War III, death, chaos, betrayal, and everything else that could hit the fan in 2012.

This sort of anxiety has led some people to use the term "doomsday" when describing the last day of the Mayan calendar. Although the theory has no solid academic backing, it is catching on. YouTube hosts countless videos of asteroids striking earth, tsunamis, tornados, and incidents of chaos linked to the date. Many devotees are preparing for hell on earth. But Voltaire says 2012 isn’t all about doom and gloom. "Our prophecies are about facing the facts and bringing up new ideas, acknowledging indigenous cultures of the past and present and truly listening to what they have to say, not brushing them off."

During our country’s time of change, we may not have heard many full-blown prophecies coming to pass, but we have all witnessed powerful people raising fresh ideas, such as rapidly shifting to new energy sources, developing international standards of human rights and controls on the use of force, and attacking poverty and disease worldwide. Like the 2012 followers, we’re listening and trying to remain open-minded.

If you chose to listen — to the prophecies or the new president — you might ask yourself how you’re supposed to prepare for the future. Voltaire says that "if you’re conscious of the changes, you’ll be able to roll with them, like if you’re in the ocean swimming with the tide. But if you’re unconscious and you suddenly wake up, it’ll be a lot harder to deal with."

Voltaire and Weidner say that our president will need to prepare too. They think that for him to be successful, he will have to address issues such as green energy and global warming brought forth at the 2012 conference.
Whether we’re believers or not, our country’s in for some big changes, whatever the solar alignment.

Project Censored

The daily dispatches and nightly newscasts of the mainstream media regularly cover terrorism, but rarely discuss how the fear of attacks is used to manipulate the public and set policy. That’s the common thread of many unreported stories last year, according to an analysis by Project Censored.

Since 1976, Sonoma State University has released an annual survey of the top 25 stories the mainstream media failed to report or reported poorly. Culled from worldwide alternative news sources, vetted by students and faculty, and ranked by judges, the stories were not necessarily overtly censored. But their controversial subjects, challenges to the status quo, or general under-the-radar subject matter might have kept them from the front pages. Project Censored recounts them, accompanied by media analysis, in a book of the same name published annually by Seven Stories Press.

"This year, war and civil liberties stood out," Peter Phillips, project director since 1996, said of the top stories. "They’re closely related and part of the War on Terror that has been the dominant theme of Project Censored for seven years, since 9/11."

Whether it’s preventing what one piece of legislation calls "homegrown terrorism" by federally funding the study of radicalism, using vague concerns about security to quietly expand NAFTA, or refusing to count the number of Iraqi civilians killed in the war, the threat of terrorism is being used to silence people and expand power.

"The war on terror is a sort of mind terror," said Nancy Snow, one of the project’s 24 judges and an associate professor of public diplomacy at the Newhouse School of Public Communications at Syracuse University. Snow — who has taught classes on war, media, and propaganda — elaborated: "You can’t declare war on terror. It’s a tactic used by groups to gain publicity and it will remain with us. But it’s unlikely that [the number of terrorist acts] will spike. It spikes in the minds of people."

She pointed out that the number of terrorist attacks has dropped worldwide since 2003. Some use the absence of fresh attacks as evidence that the so-called war on terror is working. But a RAND Corporation study for the Department of Defense released in August said the war on terror hasn’t effectively undermined Al Qaeda. It suggested the phrase be replaced with the less loaded term "counterterrorism."

Both Phillips and Snow agree that comprehensive, contextual reporting is missing from most of the coverage. "That’s one of my criticisms of the media," Snow said. "They spotlight issues and don’t look at the entire landscape."

This year the landscape of Project Censored itself is expanding. After talking with educators who bemoan the ongoing decline of news quality and want to help, Phillips launched the Truth Emergency Project, in which Sonoma State partners with 23 other universities. All will host classes for students to search out untold stories, vet them for accuracy, and submit them for consideration to Project Censored.

"There’s a renaissance of independent media," Phillips said. He thinks bloggers and citizen journalists are filling crucial roles left vacant by staff cutbacks throughout the mainstream media. And, he said, it’s time for universities, educators, and media experts to step in and help. "It’s not just reforming the media, but supporting them in as many ways as they need, like validating stories by fact-checking."

The Truth Emergency Project will also host a news service that aggregates the top 12 independent media sources and posts them on one page. "So you can get an RSS feed from all the major independent news sources we trust," he said. Discerning newshounds can find reporting from the BBC, Democracy Now!, and Inter Press Service (IPS) in one spot. "The whole criteria," he said, "is no corporate media."

Carl Jensen, who started Project Censored in 1976, said the expansion is a new and necessary phase. "It answers the question I was always challenged with: how do you know this is the truth? Having 24 campuses reviewing all the stories and raising questions really provides a good answer. These stories will be vetted more than Sarah Palin."

Phillips said he hopes to expand to 100 schools within the year, and would like the project to bring more attention to the dire need for public support for high quality news reporting. "I think it’s going to require government subsidies and nonprofit organizations doing community media projects," he said. "It’s more than just reforming at the FCC level. It’s building independent media from the ground up."

Phillips likens it to the boom in microbrewed beer and the spread of independently-owned pubs: "If we can have a renaissance in beer-making, following established purity standards, then we can do it with our media, too." But for now, we have Project Censored, whose top 10 underreported stories for 2008 are:

1. HOW MANY IRAQIS HAVE DIED?


Nobody knows exactly how many lives the Iraq War has claimed. But even more astounding is that so few journalists have mentioned the issue or cited the top estimate: 1.2 million.

During August and September 2007, Opinion Research Business, a British polling group, surveyed 2,414 adults in 15 of 18 Iraqi provinces and found that more than 20 percent had experienced at least one war-related death since March 2003. Using common statistical study methods, it determined that as many as 1.2 million people had been killed since the war began.

The US military, claiming it keeps no count, still employs civilian death data as a marker of progress. For example, in a Sept. 10, 2007, report to Congress, Gen. David Petraeus said, "Civilian deaths of all categories, less natural causes, have also declined considerably, by over 45 percent Iraq-wide since the height of the sectarian violence in December."

But whose number was he using? Estimates range wildly and are based on a variety of sources, including hospital, morgue, and media reports, as well as in-person surveys.

In October 2006, the British medical journal Lancet published a Johns Hopkins University study vetted by four independent sources that counted 655,000 dead, based on interviews with 1,849 households. It updated a similar study from 2004 that counted 100,000 dead. The Associated Press called it "controversial."

The AP began its own count in 2005 and by 2006 said that at least 37,547 Iraqis had lost their lives due to war-related violence, but called it a minimum estimate at best and didn’t include insurgent deaths.

Iraq Body Count, a group of US and UK citizens who aggregate numbers from media reports on civilian deaths, puts the figure between 87,000 and 95,000. In January 2008, the World Health Organization and the Iraqi government did door-to-door surveys of nearly 10,000 households and put the number of dead at 151,000.

The 1.2 million figure is out there, too, which is higher than the Rwandan genocide death toll and closing in on the 1.7 million who perished in Cambodia’s killing fields. It raises questions about the real number of deaths from US aerial bombings and house raids, and challenges the common assumption that this is a war in which Iraqis are killing Iraqis.

Justifying the higher number, Michael Schwartz, writing on the blog AfterDowningStreet.org, pointed to a fact reported by the Brookings Institute that US troops have, over the past four years, conducted about 100 house raids a day — a number that has recently increased with assistance from Iraqi soldiers.

Brutality during these house searches has been documented by returning soldiers, Iraqi civilians, and independent journalists (See #9 below). Schwartz suggests the aggressive "element of surprise" tactics employed by soldiers is likely resulting in several thousands of deaths a day that either go unreported or are categorized as insurgent casualties.

The spin is having its intended effect: a February 2007 AP poll showed Americans gave a median estimate of 9,890 Iraqi deaths as a result of the war, a number far below that cited in any credible study.

2. NAFTA ON STEROIDS


Coupling the perennial issue of security with Wall Street’s measures of prosperity, the leaders of the three North American nations convened the Security and Prosperity Partnership. The White House–led initiative — launched at a March 23, 2005, meeting of President Bush, Mexico’s then-president Vicente Fox, and Canadian Prime Minister Paul Martin — joins beefed-up commerce with coordinated military operations to promote what it calls "borderless unity."

Critics call it "NAFTA on steroids." However, unlike NAFTA, the SPP was formed in secret, without public input.

"The SPP is not a law, or a treaty, or even a signed agreement," Laura Carlsen wrote in a report for the Center for International Policy. "All these would require public debate and participation of Congress, both of which the SPP has scrupulously avoided."

Instead the SPP has a special workgroup: the North American Competitiveness Council. It’s a coalition of private companies that are, according to the SPP Web site, "adding high-level business input [that] will assist governments in enhancing North America’s competitive position and engage the private sector as partners in finding solutions."

The NACC includes the Chevron Corporation, Ford Motor Company, General Electric, Lockheed Martin Corporation, Merck & Co. Inc., New York Life Insurance Co., Procter & Gamble Co., and Wal-Mart Stores, Inc.

"Where are the environmental council, the labor council, and the citizen’s council in this process?" Carlsen asked.

A look at NAFTA’s unpopularity among citizens in all three nations is evidence of why its expansion would need to be disguised. "It’s a scheme to create a borderless North American Union under US control without barriers to trade and capital flows for corporate giants, mainly US ones," wrote Steven Lendman in Global Research. "It’s also to insure America gets free and unlimited access to Canadian and Mexican resources, mainly oil, and in the case of Canada, water as well."

3. INFRAGARD GUARDS ITSELF


The FBI and Department of Homeland Security have effectively deputized 23,000 members of the business community, asking them to tip off the feds in exchange for preferential treatment in the event of a crisis. "The members of this rapidly growing group, called InfraGard, receive secret warnings of terrorist threats before the public does — and, at least on one occasion, before elected officials," Matthew Rothschild wrote in the March 2008 issue of The Progressive.

InfraGard was created in 1996 in Cleveland as part of an FBI probe into cyberthreats. Yet after 9/11, membership jumped from 1,700 to more than 23,000, and now includes 350 of the nation’s Fortune 500 companies. Members typically have a stake in one of several crucial infrastructure industries, including agriculture, banking, defense, energy, food, telecommunications, law enforcement, and transportation. The group’s 86 chapters coordinate with 56 FBI field offices nationwide.

While FBI Director Robert Mueller has said he considers this segment of the private sector "the first line of defense," the American Civil Liberties Union issued a grave warning about the potential for abuse. "There is evidence that InfraGard may be closer to a corporate TIPS program, turning private-sector corporations — some of which may be in a position to observe the activities of millions of individual customers — into surrogate eyes and ears for the FBI," it cautioned in an August 2004 report.

"The FBI should not be creating a privileged class of Americans who get special treatment," Jay Stanley, public education director of the ACLU’s technology and liberty program, told Rothschild.

And they are privileged: a DHS spokesperson told Rothschild that InfraGard members receive special training and readiness exercises. They’re also privy to protected information that is usually shielded from disclosure under the trade secrets provision of the Freedom of Information Act.

The information they have may be of critical importance to the general public, but first it goes to the privileged membership — sometimes before it’s released to elected officials. As Rothschild related in his story, on Nov. 1, 2001, the FBI sent an alert to InfraGard members about a potential threat to bridges in California. Barry Davis, who worked for Morgan Stanley, received the information and relayed it to his brother Gray, then governor of California, who released it to the public.

Steve Maviglio, Davis’s press secretary at the time, told Rothschild, "The governor got a lot of grief for releasing the information. In his defense, he said, ‘I was on the phone with my brother, who is an investment banker. And if he knows, why shouldn’t the public know?’<0x2009>"

4. ILEA: TRAINING GROUND FOR ILLEGAL WARS?


The School of the Americas earned an unsavory reputation in Latin America after many graduates of the Fort Benning, Ga., facility turned into counterinsurgency death squad leaders. So the International Law Enforcement Academy recently installed by the Unites States in El Salvador — which looks, acts, and smells like the SOA — is also drawing scorn.

The school, which opened in June 2005 before the Salvadoran National Assembly approved it, has a satellite operation in Peru and is funded with $3.6 million from the US Treasury and staffed with instructors from the DEA, ICE, and FBI. It’s tasked with training 1,500 police officers, judges, prosecutors, and other law enforcement agents in counterterrorism techniques per year. It’s stated purpose is to make Latin America "safe for foreign investment" by "providing regional security and economic stability and combating crime."

ILEAs aren’t new, but past schools located in Hungary, Thailand, Botswana, and Roswell, N.M., haven’t been terribly controversial. Yet Salvadoran human rights organizers take issue with the fact that, in true SOA fashion, the ILEA releases neither information about its curriculum nor a list of students and graduates. Additionally, the way the school slipped into existence without public oversight has raised ire.

As Wes Enzinna noted in a North American Congress on Latin America report, when the US decided it wanted a training ground in Latin America, El Salvador was not the first choice. In 2002 US officials selected Costa Rica as host — a country that doesn’t even have an army. The local government signed on and the plan made headlines. But when citizens learned about it, they revolted and demanded the government change the agreement. The US bailed for a more discreet second attempt in El Salvador.

"Members of the US Congress were not briefed about the academy, nor was the main opposition party in El Salvador, the Farabundo Martí-National Liberation Front (FMLN)," Enzinna wrote. "But once the news media reported that the two countries had signed an official agreement in September, activists in El Salvador demanded to see the text of the document." Though they tried to garner enough opposition to kill the agreement, the National Assembly narrowly ratified it.

Now, after more than three years in operation, critics point out that Salvadoran police, who account for 25 percent of the graduates, have become more violent. A May 2007 report by Tutela Legal implicated Salvadoran National Police (PNC) officers in eight death squad–style assassinations in 2006.

El Salvador’s ILEA recently received another $2 million in US funding through the congressionally approved Mérida Initiative — but still refuses to adopt a more transparent curriculum and administration, despite partnering with a well-known human rights leader. Enzinna’s FOIA requests for course materials were rejected by the government, so no one knows exactly what the school is teaching, or to whom.

5. SEIZING PROTEST


Protesting war could get you into big trouble, according to a critical read of two executive orders recently signed by President Bush. The first, issued July 17, 2007, and titled, "Blocking property of certain persons who threaten stabilization efforts in Iraq," allows the feds to seize assets from anyone who "directly or indirectly" poses a risk to the US war in Iraq. And, citing the modern technological ease of transferring funds and assets, the order states that no prior notice is necessary before the raid.

On Aug. 1, Bush signed another order, similar but directed toward anyone undermining the "sovereignty of Lebanon or its democratic processes and institutions." In this case, the Secretary of the Treasury can seize the assets of anyone perceived as posing a risk of violence, as well as the assets of their spouses and dependents, and bans them from receiving any humanitarian aid.

Critics say the orders bypass the right to due process and the vague language makes manipulation and abuse possible. Protesting the war could be perceived as undermining or threatening US efforts in Iraq. "This is so sweeping, it’s staggering," said Bruce Fein, a former Reagan administration official in the Justice Department who editorialized against it in the Washington Times. "It expands beyond terrorism, beyond seeking to use violence or the threat of violence to cower or intimidate a population."

6. RADICALS = TERRORISTS


On Oct. 23, 2007, the House of Representatives overwhelmingly passed — by a vote of 404-6 — the "Violent Radicalization and Homegrown Terrorism Prevention Act," designed to root out the causes of radicalization in Americans.

With an estimated four-year cost of $22 million, the act establishes a 10-member National Commission on the Prevention of Violent Radicalization and Homegrown Terrorism, as well as a university-based Center of Excellence "to examine the social, criminal, political, psychological, and economic roots of domestic terrorism," according to a press release from the bill’s author, Rep. Jane Harman (D-Los Angeles).

During debate on the bill, Harman said, "Free speech, espousing even very radical beliefs, is protected by our Constitution. But violent behavior is not."

Jessica Lee, writing in the Indypendent, a newspaper put out by the New York Independent Media Center, pointed out that in a later press release Harman stated: "the National Commission [will] propose to both Congress and [Department of Homeland Security Secretary Michael] Chertoff initiatives to intercede before radicalized individuals turn violent."

Which could be when they’re speaking, writing, and organizing in ways that are protected by the First Amendment. This redefines civil disobedience as terrorism, say civil rights experts, and the wording is too vague. For example, the definition of "violent radicalization" is "the process of adopting or promoting an extremist belief system for the purpose of facilitating ideologically based violence to advance political, religious, or social change."

"What is an extremist belief system? Who defines this? These are broad definitions that encompass so much…. It is criminalizing thought and ideology," said Alejandro Queral, executive director of the Northwest Constitutional Rights Center in Portland, Ore.

Though the ACLU recommended some changes that were adopted, it continued to criticize the bill. Harman, in a response letter, said free speech is still free and stood by the need to curb ideologically-based violence.

The story didn’t make it onto the CNN ticker, but enough independent sources reported on it that the equivalent Senate Bill 1959 has since stalled. After introducing the bill, Sen. Susan Collins (R-Me.), later joined forces with Sen. Joe Lieberman (I-Conn.) on a report criticizing the Internet as a tool for violent Islamic extremism.

Despite an outcry from civil liberties groups, days after the report was released Lieberman demanded that YouTube remove a number of Islamist propaganda videos. YouTube canned some that broke their rules regarding violence and hate speech, but resisted censoring others. The ensuing battle caught the attention of the New York Times, and on May 25 it editorialized against Lieberman and S 1959.

7. SLAVERY’S RUNNER-UP


Every year, about 121,000 people legally enter the United States to work with H-2 visas, a program legislators are touting as part of future immigration reform. But Rep. Charles Rangel (D-N.Y.) called this guest worker program "the closest thing I’ve ever seen to slavery."

The Southern Poverty Law Center likened it to "modern day indentured servitude." They interviewed thousands of guest workers and reviewed legal cases for a report released in March 2007, in which authors Mary Bauer and Sarah Reynolds wrote, "Unlike US citizens, guest workers do not enjoy the most fundamental protection of a competitive labor market — the ability to change jobs if they are mistreated. Instead, they are bound to the employers who ‘import’ them. If guest workers complain about abuses, they face deportation, blacklisting, or other retaliation."

When visas expire, workers must leave the country, hardly making this the path to permanent citizenship legislators are looking for. The H-2 program mimics the controversial bracero program, established through a joint agreement between Mexico and the United States in 1942 that brought 4.5 million workers over the border during the 22 years it was in effect.

Many legal protections were written into the program, but in most cases they existed only on paper in a language unreadable to employees. In 1964 the program was shuttered amid scores of human rights abuses and complaints that it undermined petitions for higher wages from US workers. Soon after, United Farm Workers organized, which César Chávez said would have been impossible if the bracero program still existed.

Years later, it essentially still does. The H-2A program, which accounted for 32,000 agricultural workers in 2005, has many of the same protections — and many of the same abuses. Even worse is the H-2B program, used by 89,000 non-agricultural workers annually. Created by the Immigration Reform and Control Act of 1986, none of the safeguards of the H-2A visa are legally required for H-2B workers.

Still, Mexicans are literally lining up for H-2B status, the stark details of which were reported by Felicia Mello in The Nation. Furthermore, thousands of illegal immigrants are employed throughout the country, providing cheap, unprotected labor and further undermining the scant provisions of the laws. Labor contractors who connect immigrants with employers are stuffing their pockets with cash, while the workers return home with very little money.

The Southern Poverty Law Center outlined a list of comprehensive changes needed in the program, concluding, "For too long, our country has benefited from the labor provided by guest workers but has failed to provide a fair system that respects their human rights and upholds the most basic values of our democracy. The time has come for Congress to overhaul our shamefully abusive guest worker system."

8. BUSH CHANGES THE RULES


The Bush administration’s Office of Legal Counsel in the Department of Justice has been issuing classified legal opinions about surveillance for years. As a member of the Senate Intelligence Committee, Sen. Sheldon Whitehouse (D-R.I.) had access to the DOJ opinions on presidential power and had three declassified to show how the judicial branch has, in a bizarre and chilling way, assisted President Bush in circumventing its own power.

According to the three memos:

"There is no constitutional requirement for a President to issue a new executive order whenever he wishes to depart from the terms of a previous executive order. Rather than violate an executive order, the President has instead modified or waived it";

"The President, exercising his constitutional authority under Article II, can determine whether an action is a lawful exercise of the President’s authority under Article II," and

"The Department of Justice is bound by the President’s legal determinations."

Or, as Whitehouse rephrased in a Dec. 7, 2007, Senate speech: "I don’t have to follow my own rules, and I don’t have to tell you when I’m breaking them. I get to determine what my own powers are. The Department of Justice doesn’t tell me what the law is. I tell the Department of Justice what the law is."

The issue arose within the context of the Protect America Act, which expands government surveillance powers and gives telecom companies legal immunity for helping. Whitehouse called it "a second-rate piece of legislation passed in a stampede in August at the behest of the Bush administration."

He pointed out that the act does not prohibit spying on Americans overseas — with the exception of an executive order that permits surveillance only of Americans whom the Attorney General determines to be "agents of a foreign power."

"In other words, the only thing standing between Americans traveling overseas and government wiretap is an executive order," Whitehouse said in an April 12 speech. "An order this president, under the first legal theory I cited, claims he has no legal obligation to obey."

Whitehouse, a former US Attorney, legal counsel to Rhode Island’s governor, and Rhode Island Attorney General who took office in 2006, went on to point out that Marbury vs. Madison, written by Chief Justice John Marshall in 1803, established that it is "emphatically the province and duty of the judicial department to say what the law is."

9. SOLDIERS SPEAK OUT


Hearing soldiers recount their war experiences is the closest many people come to understanding the real horror, pain, and confusion of combat. One would think that might make compelling copy or powerful footage for a news outlet. But in March, when more than 300 veterans from the wars in Iraq and Afghanistan convened for four days of public testimony on the war, they were largely ignored by the media.

Winter Soldier was designed to give soldiers a public forum to air some of the atrocities they witnessed. Originally convened by Vietnam Vets Against the War in January 1971, more than 100 Vietnam veterans and 16 civilians described their war experiences, including rapes, torture, brutalities, and killing of non-combatants. The testimony was entered into the Congressional Record, filmed, and shown at the Cannes Film Festival.

Iraq Veterans Against the War hosted the 2008 reprise of the 1971 hearings. Aaron Glantz, writing in One World, recalled testimony from former Marine Cpl. Jason Washburn, who said, "his commanders encouraged lawless behavior. ‘We were encouraged to bring ‘drop weapons,’ or shovels. In case we accidentally shot a civilian, we could drop the weapon on the body and pretend they were an insurgent.’<0x2009>"

An investigation by Chris Hedges and Laila Al-Arian in The Nation that included interviews with 50 Iraq war veterans also revealed an overwhelming lack of training and resources, and a general disregard for the traditional rules of war.

Though most major news outlets sent staff to cover New York’s Fashion Week, few made it to Silver Spring, Md. for the Winter Soldier hearings. Fortunately, KPFA and Pacifica Radio broadcast the testimonies live and, in an update to the story, said they were "deluged with phone calls, e-mails, and blog posts from service members, veterans, and military families thanking us for breaking a cultural norm of silence about the reality of war." 10. APA HELPS CIA TORTURE


Psychologists have been assisting the CIA and US military with interrogation and torture of Guantánamo detainees — which the American Psychological Association has said is fine, despite objections from many of its 148,000 members.

A 10-member APA task force convened on the divisive issue in July 2005 and found that assistance from psychologists was making the interrogations safe and the group deferred to US standards on torture over international human-rights organizations’ definitions.

The task force was criticized by APA members for deliberating in secret, and later it was revealed that six of the 10 participants had ties to the armed services. Not only that, but as Katherine Eban reported in Vanity Fair, "Psychologists, working in secrecy, had actually designed the tactics and trained interrogators in them while on contract to the CIA."

In particular, psychologists James Mitchell and Bruce Jessen, neither of whom are APA members, honed a classified military training program known as SERE [Survival, Evasion, Resistance, Escape] that teaches soldiers how to tough out torture if captured by enemies. "Mitchell and Jessen reverse-engineered the tactics inflicted on SERE trainees for use on detainees in the global war on terror," Eban wrote.

And, as Mark Benjamin noted in a Salon article, employing SERE training — which is designed to replicate torture tactics that don’t abide by Geneva Convention standards — refutes past administration assertions that current CIA torture techniques are safe and legal. "Soldiers undergoing SERE training are subject to forced nudity, stress positions, lengthy isolation, sleep deprivation, sexual humiliation, exhaustion from exercise, and the use of water to create a sensation of suffocation," Benjamin wrote.

Eban’s story outlined how SERE tactics were spun as "science" despite a lack of data and the critique that building rapport works better than blows to the head. Specifically, he said, it’s been misreported that CIA torture techniques got Al Qaeda operative Abu Zubaydah to talk, when it was actually FBI rapport-building. In spite of this, SERE techniques became standards in interrogation manuals that eventually made their way to US officers guarding Abu Ghraib.

Ongoing uproar within the APA resulted in a petition to make an official policy limiting psychologists’ involvement in interrogations. On Sept. 17, a majority of 15,000 voting members approved a resolution stating that psychologists may not work in settings where "persons are held outside of, or in violation of, either International Law (e.g., the UN Convention Against Torture and the Geneva Conventions) or the US Constitution (where appropriate), unless they are working directly for the persons being detained or for an independent third party working to protect human rights."

Akashic Books’ initial 2002 publication of High Life was not much of a cause célèbre in the larger literary world. But the ultraviolent novel of sex, murder, and scatology in mid-1990s Los Angeles was a definitive moment in the development of the so-called "torture porn" subgenre. As the debut author for Dennis Cooper’s Little House on the Bowery imprint, Matthew Stokoe became both a disciple of glorious S-M writers like Cooper, Bret Easton Ellis, and Samuel R. Delany and a centurial groundbreaker. Now a reprint edition of High Life (Akashic Books, 330 pages, $15.95) is belatedly securing Stokoe’s rank as either a literary assassin or putrid gore hound.

Set in the seamy pasteboard backlots of Hollywood, High Life centers around doughnut worker Jack and his prostitute girlfriend, Karen, who goes missing after a sordid organ donation. When Jack discovers Karen’s mutilated body some days later, he sets out on a sociopathic journey through the city’s back alleys and fetish clubs. Along the way he meets a twisted vice cop, Ryan — a psychological foil who elicits unspeakable fantasies from Jack — and Bella, a femme fatale whose character seems to have sprung from the pen of Georges Bataille rather than the typewriter of James M. Cain. While most of High Life obsessively centers on themes that are requisite to the noir genre, the graphic detail and repetition with which scenes of necrophilia, rape, mutilation, and coprophagy are recounted seems mechanized, if not completely militarized.

Written on the cusp of 2001’s radical political, cultural, and social turn in the wake of 9/11, High Life is a strikingly prescient view of a celebrity death culture that teeters between antebellum fantasia and post-Lapsarian horror. Stokoe’s novel arrived at the very cusp of a post–9/11 glut of torture porn, or, as David Edelstein of New York magazine described it (in a portmanteau of gore and porno), "gorno."

As characterized by Edelstein, gorno is a cross-generic exploration of graphic violence and sex alongside themes of terrorism, collective anxiety, and xenophobia. Commercial films like the Hostel series (2005; 2007) and Saw series (2004-2007), as well as Wolf Creek (2005) and Grindhouse (2007) introduced the movement’s adrenalinized visual tropes to the largest audiences, but the art and literary worlds have their controversial contributors, such as the Chapman brothers and the writer known as J.T. LeRoy. When asked to defend their creations, most of these artists use a common refrain of confrontation — that they are out to challenge the last remaining taboos, the increasingly militarized capital of the West, and a society where fear has literally mutated the body.

As if anticipating the shield behind which they would slice and dice their work, in 2000 the postmodern theorist Paul Virilio wrote of artists out to break "the taboos of suffocating bourgeois culture … the unicity of mankind, through the impending explosion of a genetic bomb that will be to biology what the atomic bomb was to physics…. Without limits, there is no value; without value, there is no esteem, no respect, and especially no pity: death to the referee!"

Yet such analysis leaves gorno artists like Stokoe in a critical limbo. Are they heroes of a new kind of anatomical avant-culture emancipated from capital and the military strictures of biopolitics? Or are they fetishists whose claims of degeneracy-as-art are a camouflage for something far more sinister? High Life hardly solves the conundrum, as Stokoe’s professed role is not as satirist or philosopher but pugilist; he refuses to ponder the possibilities of answers, only the certainty of bloodletting.

Learning the Lessons of Iraq

NEW YORK – The Iraq war has been replaced by the declining economy as the most important issue in America’s presidential election campaign, in part because Americans have come to believe that the tide has turned in Iraq: the troop “surge” has supposedly cowed the insurgents, bringing a decline in violence. The implications are clear: a show of power wins the day.

It is precisely this kind of macho reasoning that led America to war in Iraq in the first place. The war was meant to demonstrate the strategic power of military might. Instead, the war showed its limitations. Moreover, the war undermined America’s real source of power – its moral authority.

Recent events have reinforced the risks in the Bush administration’s approach. It was always clear that the timing of America’s departure from Iraq might not be its choice – unless it wanted to violate international law once again. Now, Iraq is demanding that American combat troops leave within twelve months, with all troops out in 2011.

To be sure, the reduction in violence is welcome, and the surge in troops may have played some role. Yet the level of violence, were it taking place anywhere else in the world, would make headlines; only in Iraq have we become so inured to violence that it is a good day if only 25 civilians get killed.

And the role of the troop surge in reducing violence in Iraq is not clear. Other factors were probably far more important, including buying off Sunni insurgents so that they fight with the United States against Al Qaeda. But that remains a dangerous strategy. The US should be working to create a strong, unified government, rather than strengthening sectarian militias. Now the Iraqi government has awakened to the dangers, and has begun arresting some of the leaders whom the American government has been supporting. The prospects of a stable future look increasingly dim.

That is the key point: the surge was supposed to provide space for a political settlement, which would provide the foundations of long-term stability. That political settlement has not occurred. So, as with the arguments used to justify the war, and the measures of its success, the rationale behind surge, too, keeps shifting.

Meanwhile, the military and economic opportunity costs of this misadventure become increasingly clear. Even if the US had achieved stability in Iraq, this would not have assured victory in the “war on terrorism,” let alone success in achieving broader strategic objectives. Things have not been going well in Afghanistan, to say the least, and Pakistan looks ever more unstable.

Moreover, most analysts agree that at least part of the rationale behind Russia’s invasion of Georgia, reigniting fears of a new Cold War, was its confidence that, with America’s armed forces pre-occupied with two failing wars (and badly depleted because of a policy of not replacing military resources as fast as they are used up), there was little America could do in response. Russia’s calculations proved correct.

Even the largest and richest country in the world has limited resources. The Iraq war has been financed entirely on credit; and partly because of that, the US national debt has increased by two-thirds in just eight years.

But things keep getting worse: the deficit for 2009 alone is expected to be more than a half-trillion dollars, excluding the costs of financial bail-outs and the second stimulus package that almost all economists now say is urgently needed. The war, and the way it has been conducted, has reduced America’s room for maneuver, and will almost surely deepen and prolong the economic downturn.

The belief that the surge was successful is especially dangerous because the Afghanistan war is going so poorly. America’s European allies are tiring of the endless battles and mounting casualties. Most European leaders are not as practiced in the art of deception as the Bush administration; they have greater difficulty hiding the numbers from their citizens.

The British, for example, are well aware of the problems that they repeatedly encountered in their imperial era in Afghanistan. America will, of course, continue to put pressure on its allies, but democracy has a way of limiting the effectiveness of such pressure. Popular opposition to the Iraq war made it impossible for Mexico and Chile to give into American pressure at the United Nations to endorse the invasion; the citizens of these countries were proven right.

But back in America, the belief that the surge “worked” is now leading many to argue that more troops are needed in Afghanistan. True, the war in Iraq distracted America’s attention from Afghanistan. But the failures in Iraq are a matter of strategy, not troop strength. It is time for America, and Europe, to learn the lessons of Iraq – or, rather, relearn the lessons of virtually every country that tries to occupy another and determine its future.

Locking up the press

On Aug. 20 the San Francisco Chronicle reported that video blogger Josh Wolf, who spent 226 days in federal prison in 2006 for refusing to testify before a grand jury and hand over his video of a protest turned violent, had begun working as a reporter with the Palo Alto Daily Post.

"Video blogger gets job as ‘real journalist,’<0x2009>" crowed the headline.

The article noted that some critics believe Wolf was a protest participant and not an impartial news gatherer, and accurately observed that his case fueled the debates over what defines a reporter and who deserves to be protected by the reporter’s privilege to protect confidential sources.

But it failed to mention that one of Wolf’s harshest critics was Chronicle columnist Debra Saunders, nor did it clarify that in recent years several federal courts have found that reporters — all reporters, even from major newspapers — can be forced to testify before grand juries.

California doesn’t allow its courts to compel journalists to reveal unpublished information, but the federal government has no such shield law. That’s why prosecutors could jail New York Times reporter Judith Miller, charge Chronicle reporters Lance Williams and Mark Fainaru-Wada with contempt, and slap USA Today‘s Toni Locy with hefty fines — all for refusing to disclose confidential sources and materials.

And as reporters continue to face contempt charges in federal court cases nationwide, Congress has been considering two very different versions of a federal shield bill.

These two versions take widely varying approaches toward who and what is protected. And thanks to Senate Republicans, who blocked all business not related to energy legislation before Congress’ August recess, a vote on the Senate bill did not occur at the end of July.

As a result, if the Senate doesn’t act by the end of September, both versions of the federal shield will likely die. And, depending on whom you talk to, that may or may not be a good thing.

The Free Flow of Information Act of 2007 (HR 2102), which the House of Representatives passed in October of that year, only protects journalists if their work is done for a substantial portion of the person’s livelihood or for substantial financial gain. In other words, no protection for Wolf, for most bloggers, or for many freelancers.

The good news is that the House bill extends protections to any documents or information obtained during the newsgathering process.

By comparison, the Senate bill (S 2035) only protects the identity of confidential sources, and any records, data, documents, or information obtained under a promise of confidentiality.

The Senate shield would cover any journalist who "engages in the regular gathering, preparing, collecting, photographing, recording, writing, editing, reporting, or publishing of news or information that concerns local, national, or international events or other matters of public interest for dissemination to the public."

But it no longer requires the government to prove by preponderance of evidence that the information it seeks is essential, or that it has exhausted all other methods. And it makes more difficult any challenge by the reporter, based on whether the information involved is "properly classified" or whether its disclosure would harm national security.

It also expands the list of exceptions for which protection would be precluded: if disclosure could prevent criminal activities, terrorism, kidnapping, or imminent death or bodily harm; identify a person who has released some categories of private business and medical information; and where reporters witness criminal or tortuous conduct.

"I can’t overstate how much better the House bill is," Lucy Dalglish, executive director of the Reporters Committee for Freedom of the Press, told the Guardian.

Although Dalglish is hopeful Senate Majority Leader Harry Reid (D-Nev.) will schedule the bill for a vote, she fears there won’t be enough time for a conference committee to iron out the differences between the two bills before the end of September, which means that only one version will have a chance of passing into law.

"My guess is that it will be the Senate bill, because the House will pass the Senate bill in a heartbeat, but the Senate will never pass the House bill," Dalglish observed.

Reached on break from his reporter gig, Wolf voiced his opposition to the Senate bill. "A shield law riddled with holes is no shield at all," Wolf said.

"It boggles my mind that any journalist could support the bill the way it is written," said Wolf, who would like to see a common law reporter privilege similar to the one for psychiatrists and therapists. "This is a shield law, in which, as best as I can tell, every single federal contempt case is carved out as an exception," Wolf opined.

While Dalglish acknowledges that the Senate shield only addresses subpoenas that seek to identify confidential sources (about 20 percent of subpoenas), she believes the Chronicle‘s Williams and Fainaru-Wada would have been protected, as would Locy.

"But Josh [Wolf] would not have been covered because he was not protecting confidential sources, and Judith Miller would have had a shot, though her case would have a more difficult time because of national security implications," Dalglish said. "And while by far the most subpoenas don’t have to do with confidential sources, they are the holy grail of journalism ethics, and you certainly have to, at a minimum, protect them — and the Senate bill is minimal."

Dalglish believes that both the Senate and House bills would allow the truthful, accurate, and independent gathering of information to go public, so the public could use this information at ballot boxes and in city halls, and ensure that people who have information to share could share it with reporters and the public.

"It’s not about protecting reporters," Dalglish added. "Reporters are not that special, in any shape or form. It’s about protecting the right of reporters to freely work on the public’s behalf, without being viewed as agents of the US Attorney."

Noting that the law in the Senate is not going to change what happened to Wolf in that instance because he was not protecting a confidential source, Dalglish’s message for reporters facing subpoenas, first and foremost, is: "Resist, tell them you don’t have it.

"Your obligation is to be independent, not an agent of the government," he continued. "So take your video, put it on a Web site, and make sure the public gets to see it at same time as the US Attorney."

Dreams of Obama

Barack Obama, it is true, is a transformational leader. But he needs a transformational movement to become a transformational president.

He is transformational not only by his charisma and brilliance, but by embodying the possibility of an African American being chosen president in the generation following the civil rights movement. Whether he wins or loses, the vast movement inspired by Obama will become the next generation of American social activists.

For many Americans, the possibility of Obama is a deeply personal one. I mean here the mythic Obama who exists in our imaginations, not the literal Obama whose centrist positions will disappoint many progressives.

Myths are all-important, as Obama writes in Dreams from My Father (Three Rivers Press, 2004). Fifty years ago, the mythic Obama existed only as an aspiration, an ideal, in a country where interracial love was taboo and interracial marriage was largely banned. As Obama himself declared on the night of the Iowa primary, "Some said this night would never come."

The early civil rights movement, the jazz musicians, and the Beat poets dreamed up this mythic Obama before the literal Obama could materialize. His African father and white countercultural mother dared to dream and love him into existence, incarnate him, at the creative moment of the historic march on Washington. Only the overthrow of Jim Crow segregation opened space for the dream to rise politically.

In one of his best oratorical moments, Obama summons the spirit of social movements built from the bottom up, from the Revolutionary War to the abolitionist crusade, to the women’s suffrage cause, to the eight-hour day and the rights of labor, ending with the time of his birth when the walls came down in Selma and Montgomery, Ala., and Delano. As he repeats this mantra of movements thousands of times to millions of Americans, a new cultural understanding becomes possible. This is the foundation of a new American story that is badly needed.

Obama’s emerging narrative also includes but supercedes the other major explanation of American specialness, the narrative of the "melting pot," by noting that whatever "melting" did occur was always in the face of massive and entrenched opposition from the privileged.

John McCain represents a very different aspect of the American story. His inability to limit the adventurist appetite for war is the most dangerous element of the McCain, and the Republican, worldview. It is paralleled, of course, by their inability to limit the corporate appetite for an unregulated market economy. In combination, the brew is an economy directed to the needs of the country club rich, the oil companies, and military contractors. A form of crony capitalism slouches forward in place of either competitive markets or state regulation.

Yet McCain has a good chance, the best chance among Republicans, of winning in November. He appeals to those whose idea of the future is more of the past, buying time against the inevitable. And McCain is running against Obama, who threatens our institutions and culture simply by representing the unexpected and unauthorized future.

My prediction: if he continues on course, Obama will win the popular vote by a few percentage points in November, but will be at serious risk in the Electoral College. The institution, rooted in the original slavery compromise, may be a barrier too great to overcome.

The priority for Obama supporters has to be mobilization of new, undecided, and independent voters in up-for-grabs states like Pennsylvania, Ohio, and Michigan, while expanding the Electoral College delegates in places like New Mexico, Colorado, Nevada, and possibly Virginia.

There are many outside the Obama movement who assert that the candidate is "not progressive enough," that Obama will be co-opted as a new face for American interventionism, that in any event real change cannot be achieved from the top down. These criticisms are correct. But in the end, they miss the larger point.

Most of us want President Obama to withdraw troops from Iraq more rapidly than the 16 months promised by his campaign. But it is important that Obama’s position is shared by Iraq’s prime minister and the vast majority of both our peoples. The Iraqi regime, pressured by its own people, has rejected the White House and McCain’s refusal to adopt a timetable.

The real problem with Obama’s position on Iraq is his adherence to the outmoded Baker-Hamilton proposal to leave thousands of American troops behind for training, advising and ill-defined "counterterrorism" operations. Obama should be pressured to reconsider this recipe for a low visibility counterinsurgency quagmire.

On Iran, Obama has usefully emphasized diplomacy as the only path to manage the bilateral crisis and assure the possibility of orderly withdrawal from Iraq. He should be pressed to resist any escalation.

On Afghanistan, Obama has proposed transferring 10,000 American combat troops from Iraq, which means out of the frying pan, into the fire. On Pakistan, and the possibility of a ground invasion by Afghan and US troops, this could be Obama’s Bay of Pigs, a debacle.

On Israel-Palestine, he will pursue diplomacy more aggressively, but little more. Altogether, the counterinsurgencies in Iraq, Afghanistan, and Pakistan are likely to become a spreading global quagmire and a human-rights nightmare, nullifying the funding prospects for health care reform or other domestic initiatives.

In Latin America, Obama has been out of step and out of touch with the winds of democratic change sweeping the continent. His commitment to fulfilling the United Nations anti-poverty goals, or to eradicating sweatshops through a global living wage, is underwhelming and — given his anti-terrorism wars —will be underfinanced.

And so on. The man will disappoint as well as inspire.

Once again, then, why support him by knocking on doors, sending money, monitoring polling places, and getting our hopes up? There are three reasons that stand out in my mind. First, American progressives, radicals, and populists need to be part of the vast Obama coalition, not perceived as negative do-nothings in the minds of the young people and African Americans at the center of the organized campaign.

It is not a "lesser evil" for anyone of my generation’s background to send an African American Democrat to the White House. Pressure from Obama supporters is more effective than pressure from critics who don’t care much if he wins and won’t lift a finger to help him. Second, his court appointments will keep us from a right-wing lock on social, economic, and civil liberties issues during our lifetime. Third, it should be no problem to vote for Obama and picket his White House when justified.

Obama himself says he has solid progressive roots but that he intends to campaign and govern from the center. It is a challenge to rise up, organize, and reshape the center, and build a climate of public opinion so intense that it becomes necessary to redeploy from military quagmires, take on the unregulated corporations and uncontrolled global warming, and devote resources to domestic priorities like health care, the green economy, and inner-city jobs for youth.

What is missing in the current equation is not a capable and enlightened centrist but a progressive social movement on a scale like those of the past.

The refrain is familiar. Without the militant abolitionists, including the Underground Railroad and John Brown, there would have been no pressure on President Lincoln to end slavery. Without the radicals of the 1930s, there would have been no pressure on President Franklin Roosevelt, and therefore no New Deal, no Wagner Act, no Social Security.

The creative tension between large social movements and enlightened Machiavellian leaders is the historical model that has produced the most important reforms in the course of American history.

Mainstream political leaders will not move to the left of their own base. There are no shortcuts to radical change without a powerful and effective constituency organized from the bottom up. The next chapter in Obama’s new American story remains to be written, perhaps by the most visionary of his own supporters.

Progressives need to unite for Obama, but also unite — organically at least, and not in a top-down way — on issues like peace, the environment, the economy, media reform, campaign finance, and equality like never before. The growing conflict today is between democracy and empire, and the battle fronts are many and often confusing. Even the Bush years have failed to unite American progressives as effectively as occurred during Vietnam. There is no reason to expect a President McCain to unify anything more than our manic depression.

But there is the improbable hope that the movement set ablaze by the Obama campaign will be enough to elect Obama and a more progressive Congress in November, creating an explosion of rising expectations for social movements — here and around the world — that President Obama will be compelled to meet in 2009.

That is a moment to live and fight for.

The Gysin file

I associate the dreamachine with Christmas. The first and only time I’ve directly encountered a version of the device was a holiday five or six years ago. My friend Julien used a turntable to set up a homemade dreamachine in a corner room of his family’s cabin. I took a turn sitting with my eyes closed in front of its stroboscopic play of light and darkness. I didn’t have an epileptic fit; nor did I go into a hypnagogic state. It wasn’t a drugless high, but it was a mind’s eye stimulus. I’d try the dreamachine again.

"I don’t think [the dreamachine] really works unless you’ve smoked a pipe of hash," Kenneth Anger declares during FlicKeR, Nik Sheehan’s documentary about the device and its chief creator, the writer, painter, and mystic Brion Gysin. "I think it’s too dangerous if you’ve taken acid," he adds. You get the feeling Anger is speaking from experience, even if he doesn’t face a dreamachine in front of Sheehan’s camera. Such a meeting isn’t necessary, because FlicKeR‘s first 15 minutes serves up a Who’s Who of dreamachine enthusiasts in action: Marianne Faithfull, Sonic Youth’s Lee Ranaldo, and Genesis P. Orridge of Psychic TV are among those Sheehan captures sitting and staring — with eyes closed — before the contraption’s oscilutf8g light.

The dreamachine makes for potent visual imagery, but distilling or truly conveying its effect is a tougher task for a filmmaker, even if Sheehan’s camera briefly stares directly into one (and later, incorporates Tony Conrad’s 1965 film The Flicker, a potent projector-based dreamachine corollary). For Sheehan, the mechanism provides a kinetic introduction to or threshold into, a portrait of the late Gysin. Though Gysin — who invented the Cut-Up literary methods popularized by best friend William S. Burroughs — is a shadowy figure to hang a feature-length film portrait on, FlicKeR‘s hopping, skipping, and jumping approach to his life at least energizes his enigma.

In Victor Bockris’ 1981 interview collection With William S. Burroughs: A Report From the Bunker (Seaver), Burroughs — who also says, typically, "[Gysin] taught me everything I know about painting" — relates Gysin’s description of a milk bar just after a terrorist blast: "People were lying around with their legs cut off, spattered with maraschino cherries, passion fruit, ice cream, brains, pieces of mirror and blood." Without a living subject, Sheehan must turn to various vivid Gysin acquaintances — mirror man Ira Cohen and a spry John Giorno, for example — to bring across similar illustrations of anarchic spirit. In the process, offhand observations come to mind: Genesis P. Orridge has transformed herself into a sisterly peer of rad auntie Faithfull (who praises Gysin’s warmth in her autobiography, where she’s largely disdainful of all men), for one. It’s easy to lose sight of Gysin amid such colorful characters, but FlicKeR is steadfast in its belief that Gysin is influential; a variety of academics use Gysin as a gateway to discussions of everything from the changing nature of terrorism to iPods.

He may not be the center of 20th-century history, but Gysin’s influence on the present is undeniable. This is partly due to another wave of ’60s resurgence. FlicKeR kicks off "Stoned Apocalypse," a Joel Shepard–curated Yerba Buena Center for the Arts series that includes a program devoted to the legendary light shows that overtook late-’60s music concerts. While most people associate such light shows with rock music, the new collection, The San Francisco Tape Music Center: 1960s Counterculture and the Avant-Garde (University of California Press, 322 pages, $27.50), explores its links to avant-garde cinema and music in the Bay Area.

The dreamachine-like notion and practice of live cinema is building momentum in recent years, thanks to practitioners such as Bruce Fletcher, a new surge of interest in Conrad, and a 2007 San Francisco Cinematheque series that inspired an anthology of writing on the subject. Last year at the San Francisco Museum of Modern Art, Anthony McCall’s installation You and I, Horizontal filtered Conrad’s and Gysin’s ideas about pure light into a communal rather than individual experience so potent it was akin to near-death or first-moments-of-life. That which flickers still illuminates, and it may soon turn into a piercing beam of light.

No peace, no work

OPINION Organized labor is set to mark May Day — International Workers’ Day — with what could be the loudest and most forceful demand yet for rapid withdrawal of US forces from Iraq.

Members of the International Longshore and Warehouse Union (ILWU) will lead the way by refusing to work their eight-hour morning shifts at ports in California, Oregon, and Washington. For them, it will be a "no peace, no work" holiday — in effect, a strike against the war.

Like many other unions and labor organizations nationwide, the ILWU has long opposed the war in Iraq as an imperialist action in which the lives of young working-class Americans and Iraqi citizens are being needlessly wasted.

The ILWU hopes the dramatic act of shutting down West Coast ports will inspire Americans everywhere to oppose the war.

The coalition behind this movement, US Labor Against the War (USLAW), has been growing steadily since the invasion of Iraq. It’s now the largest organized antiwar group of any kind and is drawing important support, not only from unions but from a wide variety of socially-conscious activist groups outside the labor movement.

USLAW’s members, which represent millions of workers, significantly include the AFL-CIO and most of the federation’s 56 affiliated unions. No one can doubt USLAW’s ability to organize a massive protest like the one ILWU is hoping to lead: it was USLAW that put together the antiwar demonstration that drew half a million marchers to Washington, DC last year.

USLAW is demanding primarily that "our elected leaders stop funding the war, bring our troops home, and start meeting human needs here at home," notes Fred Mason, an AFL-CIO official in Maryland.

In the meantime, says Gerald McEntee, a key public employee union leader, "We are spreading violence in Iraq, not democracy." The Bush administration’s policies, says Musicians Union leader Tom Lee, "make us less secure, increase the threat of terrorism, and have put Iraq on a path of civil war."

ILWU President Robert McEllrath has urged unions and allied groups outside the United States to also mount protests "to honor labor history and express support for the troops by bringing them home safely."

The AFL-CIO’s role is particularly notable. It marks the first time the federation has ever opposed a war, whether the president was a pro-labor Democrat or, as now, an antilabor Republican.

The longshoremen’s union, which was not affiliated with the AFL-CIO at the time, was firmly opposed to the Vietnam and Persian Gulf wars. The ILWU also was a major opponent of dictatorial regimes in South and Central America and the apartheid regime in South Africa, its members often refusing to handle cargo coming from or going to those countries. Just recently, ILWU members in Tacoma, Wash., refused for conscientious reasons to load cargo headed for the Iraq war zone.

We can only hope — and hope fervently — that the union’s May Day show of strong opposition to the war in Iraq will help prompt millions of others to conclude that they, too, cannot in good conscience support that seemingly endless war.

Off to Caracas!

Last November, as attentive readers of this blog will remember, I was declared non grata (not welcome) in Caracas, Venezuela, on a special mission of the Inter American Press Association (IAPA) to check on President Hugo Chavez’s accelerating crackdown on the news media.

We had been invited to come by the Venezuelan press who had hoped our mission would put international pressure on Chavez to guarantee press freedom during the upcoming referendum giving Chavez a lifetime presidency. On the first morning, our delegation found Chavez had declared us all non grata in a half-page advertisement from the Venezuelan National Assembly, in the big morning Caracas daily paper El Universal.

Today, as I prepare to fly out tomorrow for the spring IAPA assembly in Caracas this weekend,
I find that I am a “media terrorist.” Chavez has scheduled a counter convention close to our hotel called a “Latin American Meeting Against Media Terrorism.” Over the weekend, Chavez announced, Caracas “will be converted into the world capital of the struggle against media terrorism. It is necessary to discuss themes such as this,” Chavez said, “since media terrorism utilizes the means of communication–radio, press, television, to generate war, violence, fear and anxiety in our peoples.”

Well, we must have done some good last time around on our November mission. Chavez lost the election, even though the countryside and the airwaves were covered with his pictures and campaign slogans. This time around, things may be just as newsworthy. I’ll keep you posted. B3

Battle scarred

TV, I: Battlestar Galactica — what the frak happened? But let’s back that Viper up: as a drooling, antsy constituent of the 12 colonies, a.k.a., a total BSG dweeb, I have to confess that I’m filled with both moist-eyed, fangirl anticipation and been-burned, skeptical trepidation, awaiting the Peabody- and Emmy–winning series’s final, fourth season, which starts April 4 on the Sci-Fi channel. This from a full-on hater of the original 1978 TV series, who scorned it for its cheap-knockoff-Star Wars patina, lousy writing, and stale characterization — with the exception of Dirk Benedict’s caffeinated Starbuck. It took plenty of intelligent storytelling, compelling character-building, and thoughtful crafting of a thoroughly re-envisioned mise-en-scène — one that pointedly reflects post–Sept. 11 political, philosophical, and spiritual issues — to pull me in. So why, at the closing moments of the last episode of season three, did I find myself sneering, "Battlestar Galactica has totally jumped the shark"?

The series set the bar high, filling out the original series’s cartoonish outlines into a shadowy, visceral war for survival between polytheistic, politicking, and imperfect humans and their creations: the genocidal and monotheistic Cylon robots who eventually evolved from tin cans into perpetually reincarnating and replicating, superhumanlike Frankensteins, intent, at the series’s start, on destroying their onetime masters. BSG played satisfyingly to a viewer’s desire for both soapy, emotional involvement and more cerebral brain-teasing, spinning its narratives around topical "War on Terror" issues and deeper ideas about belief, fundamentalist or otherwise, and wartime ethics concerning terrorism, torture, prejudice, and human and reproductive rights — in addition to such questions as: What does it mean to be human? Where does artificial intelligence end and consciousness begin? And what is life itself? Viewers could enter at all levels: one can enjoy the brash, frak-it-all sass of the new Starbuck (played with cigar-chomping machisma by Katee Sackhoff), or toy with notions of whether Dr. Gaius Balthar (portrayed by the deliciously anguished James Callis) is insane or in love or has found God or has been implanted with a Cylon chip because he sees and hears his Cylon seductress/guardian angel-devil, Number Six (gratifyingly complicated in the hands of Tricia Helfer), everywhere. Or one can wonder, sudsily, whether Sharon "Boomer" Valerii (Korean Canadian Maxim hottie Grace Park) — the beloved fighter pilot turned sleeper Cylon assassin turned Cylon/human baby-maker turned officer once more — will ever overcome the "species-ist," snarky "toaster" cracks to happily rear her bi-species hapa infant? Will the humans discover their new home, the mythical 13th colony of Earth, before the Cylons do? When they get to Terra Firma, will apes or apocalyptic scenes greet the chariots of the gods?

Sure, BSG fans have undergone moments of taste-testing hamminess: is Michael Hogan — who plays the Galactica’s alcoholic Colonel Saul Tigh — an intriguing actor because he plays his character three or four different ways, or is he simply awful? Then BSG allays your fears by forging into such thought-provoking turf as suicide bombings, which the humans resorted to during last season’s Cylon occupation. Let’s see the other humans-vs.-robots series, the faltering Sarah Connor Chronicles, top that viewer-challenging gambit.

That said, the third season managed to step up the show with both the occupation and Balthar’s transformation into a Cylon mascot aboard the machines’ hallucinatory base ship — a stylishly sleek, organic-metallic metadisco of a craft that Daft Punk would surely be glad to dock into. The final bombshell: the revelation of four of the five final sleeper Cylon agents (three of whom ironically led the suicide-bombing arm of the humans’ insurrection). But much like those would-be terrorists, that final episode undermined itself as the sleeper Cylons were awakened by the thread of a song that only they can hear — a few lines that turned into a few lyrics, then blossomed into a startlingly wretched rendition of Bob Dylan’s "All along the Watchtower." A presumed-dead Starbuck reappeared, and the scene fast-forwarded to a glistening Earth.

The tone was so drastically off — the winking, boomer-centric reference to our earthly plane was so in-jokey — that I felt like I had been kicked in my Wonder Con by a guffawing Luke Skywalker look-alike in a tie-dyed ‘fro wig, flipping me the finger. It made about that much sense. The Sopranos can leave the bad taste of "Don’t Stop Believin’<0x2009>" in your mouth because AOR rock is the soundtrack to Tony Soprano’s life. But the dark, generally straight-faced BSG has been aurally embellished only by title sequence’s version of the Rig Veda’s Gayatri mantra, reworked by composer Richard Gibbs with Enya-esque new age vocals and tribal drums, as well as archetypally Hollywood orchestral fare and the odd, let’s-get-jiggy-wit’-it Irish tin-flute. Somewhere a shark is whimpering from a severe head wound created by a misfiring motorcycle, and one can only hope season four doesn’t injure more sea creatures.

SXSW: This ain’t another fear and loathing praisesong

In the wake of my man John Edwards’s withdrawal from the current presidential race and subsequent taking up the torch for our fair music editor’s fellow Punahou alumnus Obama as Negro First, I officially became old. So I lacked sufficient energy and brain cells to take on SXSW 2008 – but, music ‘ho that I am, I did it anyway.

Clearly, Barack Obama’s sustained ascent as the most dissected American presidential candidate has by now confirmed his superfly rock-star status, crowding and overshadowing the field pursued by artists with recent/forthcoming new releases such as Jack White of the Raconteurs, the brers of Gnarls Barkley, Union Jack black singing cowboy Lightspeed Champion, and Saul Williams, a.k.a., Niggy Tardust – the latter two made the South By scene all around hip Austin (and Gnarls appeared via tacked-up Odd Couple lampoons, courtesy of Atlantic). I hesitated to fly down into Bush Country, considering the volatile political climate at present and the specter of terrorism making every airport visit unpleasant at best.

And, too, I had personal reservations: at the last three South By festivals, my life has fallen apart by degrees: in 2006, with the diagnosis of my late Mother’s pancreatic cancer and decision to divorce being the absolute worst. Still, I was invited to speak about press and, whether SXSW has completely devolved into “hipster spring break with bands” in recent years, the festival retains the possibility to offer exposure to unheard-of music and/or reconnect with rarely seen friends from the Left Coast and abroad.

WEDNESDAY, MARCH 12

Rising before cockcrow at 3 a.m., I saddled up in bespoke hat, denim and black leather to hit a too-early flight out of NY LaGuardia and made it to Austin’s Bergstrom already dazed and confused via Houston connection from George Bush Airport. After a swift check-in at the Hilton Garden Inn downtown where I happened to run into my panel mate, Nick Baily of Shorefire Media, and we concurred that we were in the dark about how to express ourselves (one of last year’s highlights was meeting O.G. Expressor Charles Wright), it was off to run the Convention Center gauntlet in pursuit of festival badges, assorted data, schwag and making it to the panelists’ green room on time. No surreys nor press satoris available. So Nick and I jes’ winged it (wung it?) before a surprisingly full room, and tried our best to respond to the artists trailing in our wake all the way back to the hotel.

In memoriam: Ike Turner, Buddy Miles, Teo Macero, and Arthur Lee

"Music won’t have no race, only space…." — an eternal lyric sung by that titanic philosopher Marvin Gaye, echoing many other dusky voices, from that of pioneer Afronaut Estevanico the Black, whose exploits across the sixteenth century, proto–American West supersede words, to the United Kingdom’s newest alt-country composer Lightspeed Champion. This sensibility is at the core of the Afro-Baroque aesthetic currently being revived as Arthurian legend — King Arthur Lee, that is. From punk-haired black girls in East New York City digging his hybrid soul on the subway through their iPods, to the foremost articulators of the genre’s lush, neoclassical Afropean clash — his Los Angelean heir Stew and the Houston-born boy-king Devonte Hynes, aka Lightspeed Champion — the Arthurly is wrecked no mo’. And it’s way past prime time for the original Love man to be honored on the black-hand side.

PASSING PHASES AND STAGES


The lure of fair Europa held sway over Arthur Lee’s next-gen singer-songwriter from Crenshaw-Adams in South Central Los Angeles: Stew. No more "California Dreamin’" or uneasy rock for this brer who eschewed his colored cloister for liberation abroad. Only Stew’s Negro Problem followed him to Western Europe and then to Gotham, where he’s brought it to the Great White Way in the format of Passing Strange (2007). What makes this choreo-poem Afro-Baroque is that at this play’s core it’s a conjure of sacrifice — lush and hybridized sonic bleeding for those Negro chillun who are nominally free but not weightless enough to swing a ride on ancient Kemet’s Ark of a Million Years.

Akin to Lightspeed Champion, Stew is the product of a God-fearing background and is prone to vanguard aesthetic allusions in parallel to his younger counterpart’s preoccupations with a blend of meditation, country, gospel, punk, Rocky Horror, French minimalist composer Alain Goraguer, and my friend Galt MacDermot’s Afro-fusionist musical score for Hair. The elder art-punk Stew can go head-to-head with the Afro-punk whippersnapper over Arthurly’s thorny crown, and nothing goes over so well during Passing Strange as the first act sequence when two costars, Daniel Breaker’s Youth and Eisa Davis’s Mother, enact their tense separation in homage to European avant-garde cinema.

Yass y’all, Passing Strange, which was incubated at the Berkeley Repertory Theater and Sundance Institute, is a bona fide masterpiece, yet not without flaw. On the structural tip, even with the move from downtown to midtown requiring a tightening up of the boho flow, the second "abroad" act still lacks a satisfying resolution and includes less of Stew’s meta-Pentecostal exhortations and fourth wall–smashing. And some aspects of the play are problematic, mostly on the score of gender politricks. On Broadway, Davis’s embodiment of her Mother role seems whittled down somehow — but I ain’t gon’ get into the thick of what goes on between black men and they mamas. Then there’s the grumbling from my historian sibling and others about the play’s valorizing of the second act’s European muses above the sacred black feminine. The title is derived from Shakespeare’s Othello, and after almost two decades of experience observing America’s black rock scene, it has struck me repeatedly the degree to which many black male rockers feel they can only truly rock by acquiring a baby mama who resembles Joni Mitchell circa 1970 or, nowadays, Feist. This, even when these black Atlantic boys believe Monika Danneman murdered their beloved Saint Jimi!

Still, Stew’s genius doesn’t make me want to put the hoodoo on him or Passing Strange. Rather, when he exhorts freedom from the podium with Arthur’s Little Red Book, Stew makes me wanna holler in Little Richard’s whoo-hoo! and reach back to my Baptist pastor granddaddy’s church in Georgia for my pious MLK Jr. hand fan with the wavy popsicle stick handle.

To wit: I have seen Passing Strange several times since being taken to see it for my birthday last spring at the Public Theatre (Mayday! Mayday!). While I applaud its leap to Broadway as a lifelong supporter of black difference and arts, my obsession with it is purely personal. Aside from Stevie Wonder at a distance, whose mother died a month before mine in 2006, no one feels my pain nor comes as close to articuutf8g the loss as Stew’s play. A mid-Atlantic chile from the opposite coast, I, like Stew, come from a restrictive Christian background — A.M.E. partisans on the maternal side and preaching as virtual family biniss on the paternal — that would condemn and cast me out for my atheism. Like me at an Allmans concert, Passing Strange is a spook in the Broadway buttermilk, probing the deep history of rock ‘n’ roll incubation and conservatism in the black church.

Although Stew’s a decade older than I, I also spent my youth in the ’70s plotting how to dance my way out of the constrictions of the black bourgeoisie horrorshow. And I loved punk and other subcultural provocations for the anarchic possibilities they presented in terms of society and style. Above all, I, too, long mistook songs for love — until now, when I’m in the grips of a hurt that music ultimately cannot heal. But while I appreciate my education abroad, I differ from Stew on the Europa-as-Utopia tip. Nothing breeds contempt like familiarity.

MR. MIDDLE PASSAGE


Stew’s alter-ego, Youth, comments that, "America can’t deal with freaky Negroes!" So there’s always been black in the Union Jack, leastways when it comes to rock ‘n’ roll — from Brian Jones’s ace boon Jimi Hendrix through to today’s new eccentric Lightspeed Champion. The UK has been perennially more hospitable to creative Africans who would be free, despite Ruth Owen of Mama Shamone’s faintly damning radio doc of last year, which took the pulse of the black rock orbit on both sides of the Atlantic.

Lightspeed Champion reminds me less of this ‘n’ that name-checked Britpopper than Modesto’s recently retired armchair critic of freeway flight and exurban strip-mall anomie: Granddaddy’s Jason Lytle. Perhaps this cracked Americana element stole into the proceedings since Hynes recorded his solo debut in Omaha amongst the cabal of Bright Eyes’ Saddle Creek-dippers, but it seems such wry "from inside the scene looking out" songs as "Everyone I Know Is Listening to Crunk" suggest the subjectivity of a disaffected young man looking for a room of his own far from the urban, madding crowd of druggies, chavs, and black authenticity dealers that surround its narrator. Like Lytle’s renovation of country and western — with an emphasis on restoring the western part of the early twentieth century modern genre from the perspective of what happens when America’s run out of room for expansion — Lightspeed Champion’s brand of high lonesome is borne out of England’s dreaming during the insular nation’s nightmarish era of being "overrun" by immigrants, urban blight, and various forms of terrorism.

It is rather fascinating that Texas-born Hynes should have escaped parochial black American life due to his itinerant parents’ lifestyle only to seek out Omaha-as-omphalos for requisite head space to craft his new opus, Falling Off the Lavender Bridge (Domino). Why? Precisely because it’s his attaining maturity in England that permitted Hynes to become the swooning, anxious, vulnerable almost to the point of fey version of black manhood that pervades his finely wrought songs. His brand of Afro iconoclasm — which got him signed as a Test Icicle at 19 and now gets him fêted for sepia twang in his early 20s — would have encountered far more roadblocks on American shores where young black males are required to be consistently hard and never punks (catch the final season of The Wire). Plus ça change, eh, Josephine et Jimmy? Of course, Hynes’s will-to-flight was telegraphed from childhood when he penned a comic about a superhero from Planet Voltarz whose power derived from wielding mathematical equations. The superhero’s moniker? Lightspeed Champion, whose power in maturity will likely rest on "touring until I die."

When he performed at that East Village hip cloister Mercury Lounge before a small fawning audience sporting about — a record — six Negroes, the fur-helmeted Champion in David Ruffin’s black glasses, a self-willed superhero and Urkel-in-Little Richard’s hairpiece, seemed to be signaling that the secret power propelling him out of the dystopic urban milieu he described was not merely blowing up in America but striving to refine a hyperliterate and well-enunciated language to get his Romantic apologias across. And don’t let the widescreen alt-country symphony "Galaxy of the Lost" fool you — our Devonte’s still black enough for ya, with his disc being inspired by a lot of hip-hop and by closing his debut with an ode to his Mama: "No Surprise (For Wendela)." If Falling Off the Lavender Bridge does the biniss projected, this postmodern Professor Longhair is on his way. Watch his space.

Despite the decades of separation, Stew and his fellow black Atlantic jumper Lightspeed Champion are both still seeking newer sonic horizons, even as that campaigning purveyor of "Them Changes," B-rack Obama, is traveling electric miles to paint the White House black.

Desperately seeking cinema

Jennifer Reeves’s movies are personal wishing wells, each a repository of dreams and worries. As we see ourselves reflected in the water’s surface after tossing in a coin, so too is Reeves’s presence apparent in the handmade, fussed-over quality of her moving pictures. I use that broad designation pointedly, as her films are as varied in material and form as they are prosaic in mood and temperament. Over 15 years of independent filmmaking, the New York–based artist has created hand-painted films in the style of her mentor Stan Brakhage, freewheeling shorts, fiction fantasias, 16mm double-projections, feature narratives, and experiments in high definition. San Francisco Cinematheque hosts the formally restless filmmaker for a three-program tour.

Reeves’s early shorts channel riot-grrrl spark with scratched-up film stock. Elations in Negative (1990) is a good sample of the celluloid-mad sexual politics of these 16mm beaters, though Taste It Nine Times (1992), with its vivid pickle-biting innuendos, will be missed from the Cinematheque run. In painted films like The Girl’s Nervy (1995) and Fear of Blushing (2001), Reeves’s appropriation of Brakhage’s technique conveys playful femininity in color, pattern, and music.

Though Reeves toyed with narrative early on, most notably in 1996’s psychodrama Chronic, 2004’s The Time We Killed represented a kind of breakthrough. An unhurried 94 minutes passes through the dark mirror of an agoraphobic poet keeping to her New York apartment during the buildup to the Iraq War. "Terrorism brought me out of the house, but the war on terror drove me back in," Robyn (Lisa Jarnot) says in her peripatetic voice-over, adding later, "I’m afraid of catching the amnesia of the American people." Reeves’s magnetically immersive filmmaking is such that the political situation neatly folds into an extended experiment in subjectivity — besides being an unstinting portrait of madness (it’s everywhere in this film: in a record’s spin and neighbors’ voices echoing through the walls, in dogs’ faces, bathwater, and masturbation), The Time We Killed also serves as an understated chronicle of the collateral psychic and moral damage of our country’s manufactured warmongering.

The Time We Killed is heavier than Reeves’s other work, though it’s not without humor; she finds the ridiculous, unwieldy side of depression in Robyn’s litany of death fantasies and a painfully misguided interaction with a curious neighbor. Robyn’s locked in, but Reeves is formally unfettered, mixing conventional 16mm footage with lyrical, associative streams of inner life shot in high-contrast black-and-white. The filmmaker raids her home-movie archive for the film, in addition to using her own apartment and acting as Jarnot’s body double during the extended shooting. This air of transference makes The Time We Killed weirdly transparent, so we feel as intimately connected to Reeves’s isolated work in the editing room as we do to Robyn’s experience in the apartment.

Since The Time We Killed, Reeves has returned to more typically experimental filmmaking. Her 2006–07 Light Work variations strike an ideal balance of abstract and representational visions, in the process cataloging the changing textures of cinema. In the affecting He Walked Away (2007), Reeves dissects, refracts, and abstracts footage from her older movies to create a tri-tipped memorial piece in which the intrinsically elegiac nature of cinema is connected to the dissolution of film technology, which is then tied to the disappearing loves and friendships that shadow personal lives.

As with Guy Maddin — another filmmaker who favors overheated evocations — one has the sense that Reeves could make a hundred interesting movies from the same scraps of footage. "I want to counter the turncoats who say film’s dead," Reeves announces on her excellent new blog. "Try telling a painter that she can only use digital paint on a Mac for the rest of her life. She’d be pissed." But if she were Jennifer Reeves, she certainly wouldn’t slow down.

My so-called hell

This World of Ours, a youthfully nihilistic, epic, and episodic take on nihilistic youth in 21st-century Japan, represents the coming out of its writer and director, Nakajima Ryo, not just as a filmmaker to watch but in a larger sense as well. Nakajima made his debut feature after a period of post–high school isolation when he became a hikikomori, one of the growing number of young Japanese who voluntarily cocoon themselves in their rooms for months and sometimes years.

The fundamental disconnect that drives the hikikomori to solitary confinement is made palpable in the three high school students at the center of Nakajima’s ambitious, unwieldly, and at times ugly film, even as they flit through populated hallways and shopping arcades. At the start of the film Hiroki (Yoshihiko Taniguchi) and Ryo (Satoshi Okutso) spend their time bullying ugly duckling Mitarai (Hasegawa Souta) while enduring the verbal abuse of one of their teachers, Mr. Iwayama (Shinmon Akao). Mitarai is also a plaything for the blankly coy Ami (Arisa Hata), who encourages him to seek revenge when she isn’t shit-talking him with his tormentors.

These schoolyard cat and mouse games give way to the film’s unsettling centerpiece: after a night out drinking, Ami stumbles home alone, while the boys, at the behest of an older peer, take one of their female companions to his lair and brutally gang-rape her. The scene is clearly indebted to 1971’s A Clockwork Orange (as is the film, which also evokes Akihiko Shiota’s contemporary cruel stories of youth and even Wakamatsu Koji’s gonzo 1969 film Go Go Second Time Virgin), down to the reedy, compressed version of Beethoven’s Ninth — which, appropriately, is more suggestive of a ringtone than a symphony — on the soundtrack.

A Clockwork Orange was controversial because of its highly stylized presentation of graphic violence. Like director Stanley Kubrick, its protagonist, Alex (Malcolm McDowell), is obsessed with aesthetics: it’s not the film’s mere juxtaposition of "Ode to Joy" with heinous acts that is so shocking but rather the criminal’s adulatory investment in something so beautiful. In comparison, Nakajima’s youths hardly have an investment in anything, and the director seems marginally invested in them. Hiroki is clearly paralyzed by what he has done but is so unempathetic that he can only fret over how a criminal record will lower his already dismal prospects of landing a white-collar job. They commit their acts of self-mutilation, bullying, and murder in a zero-sum game of identity formation, with every painful twist caught by Nakajima’s washed-out, often handheld camera. If there are aesthetics at work here, they are clearly those of the YouTube auteur: Nakajima keeps his characters in anxious proximity to the lens. Every shot is practically a close-up.

It is unsurprising then, that these youths talk about Sept. 11 in tones of respectful awe, treating it as the ne plus ultra of how to leave your mark on the world. Ryo, reeling from a bloody confrontation with Iwayama and rejection at the hands of his older sister, decides — much like real-life counterpart Seung-Hui Cho or Eric Harris and Dylan Klebold — the only way out is to commit an act of terrorism. This World of Ours even opens with slo-mo footage of the Twin Towers burning, accompanied by the portentous strains of Beethoven’s Moonlight Sonata, a juxtaposition that Ryo could have made in a computer lab while cutting class.

The same music wafts over the crowded halls of the high school in Gus Van Sant’s Elephant (2003), a far more elliptical take on teen-on-teen violence whose cataclysmic ending is made all the more so by the camera’s constant gentle proximity to the revolving social cross section on display. But while Van Sant’s film seems perfumed by adolescent ennui, that isn’t the only emotion the director trafficks in. (Unfortunately, Van Sant’s most recent foray into the troubled private lives of teens, Paranoid Park — which also screens at SF IndieFest — can’t get out of its funk, despite some beautiful footage of cherubic skater boys lensed by Christopher Doyle.)

I don’t doubt the sincerity of the anger and disenfranchisement on display in Nakajima’s film or want to knock the chutzpah with which he wields them. IndieFest is about first steps, whether they’re accompanied by insecure shrugs or grandly demonstrative gestures. By the time This World of Ours has ended with a bang and much whimpering, it’s offered a few of each.

George McGovern: Impeach Bush & Cheney!

B3 note: Good for George McGovern. Good for the Washington Post for running this important timely commentary
in its Sunday edition. Question: how many other papers will run it?

The McGovern piece reminds me of a major political point: that a big reason the Pelosi Democrats in
Washington have so cravenly caved in to the Bush initiatives, on the war and much else, is because Pelosi wrongheadly pulled the impeachment issue off the table before the last election. This meant, among other things, that the Democrats at the first bugle lost their most important bit of muscle and leverage. The result has been disastrous and the war is now surging.

It’s good that Cindy Sheehan is running against Pelosi and will force these issues into the public arena. Maybe, just maybe, Pelosi will be forced to debate Sheehan and will be forced in the November election to conduct a real campaign for the first time in her home territory to keep her Speaker of the House post.

Personal note about McGovern: he comes from South Dakota, a state so conservative that it has outlawed abortions. Its eastern border is l7 miles or so from my northwestern Iowa hometown of Rock Rapids. I have followed him closely through the years. I still marvel that a liberal of his force and eloquence could represent South Dakota for so many years in Congress. Imagine if he were the Speaker of the House.

Why I Believe Bush Must Go

Nixon was bad. These guys are worse.

As we enter the eighth year of the Bush-Cheney administration, I have
belatedly and painfully concluded that the only honorable course for me is
to urge the impeachment of the president and the vice president.

After the 1972 presidential election, I stood clear of calls to impeach
President Richard M. Nixon for his misconduct during the campaign.

I thought that my joining the impeachment effort would be seen as an
expression of personal vengeance toward the president who had defeated me.

Today I have made a different choice.

Of course, there seems to be little bipartisan support for impeachment.

The political scene is marked by narrow and sometimes superficial
partisanship, especially among Republicans, and a lack of courage and
statesmanship on the part of too many Democratic politicians. So the
chances of a bipartisan impeachment and conviction are not promising.

But what are the facts?

Bush and Cheney are clearly guilty of numerous impeachable offenses.

They have repeatedly violated the Constitution.

They have transgressed national and international law.

They have lied to the American people time after time.

Their conduct and their barbaric policies have reduced our beloved country
to a historic low in the eyes of people around the world.

These are truly “high crimes and misdemeanors,” to use the constitutional
standard.

From the beginning, the Bush-Cheney team’s assumption of power was the
product of questionable elections that probably should have been officially
challenged – perhaps even by a congressional investigation.

In a more fundamental sense, American democracy has been derailed
throughout the Bush-Cheney regime.

The dominant commitment of the administration has been a murderous,
illegal, nonsensical war against Iraq.

That irresponsible venture has killed almost 4,000 Americans, left many
times that number mentally or physically crippled, claimed the lives of an
estimated 600,000 Iraqis (according to a careful October 2006 study from
the Johns Hopkins Bloomberg School of Public Health) and laid waste their
country.

The financial cost to the United States is now $250 million a day and is
expected to exceed a total of $1 trillion, most of which we have borrowed
from the Chinese and others as our national debt has now climbed above $9
trillion – by far the highest in our national history.

All of this has been done without the declaration of war from Congress that
the Constitution clearly requires, in defiance of the U.N. Charter and in
violation of international law.

This reckless disregard for life and property, as well as constitutional
law, has been accompanied by the abuse of prisoners, including systematic
torture, in direct violation of the Geneva Conventions of 1949.

I have not been heavily involved in singing the praises of the Nixon
administration.

But the case for impeaching Bush and Cheney is far stronger than was the
case against Nixon and Vice President Spiro T. Agnew after the 1972 election.

The nation would be much more secure and productive under a Nixon
presidency than with Bush. Indeed, has any administration in our national
history been so damaging as the Bush-Cheney era?

How could a once-admired, great nation fall into such a quagmire of
killing, immorality and lawlessness?

It happened in part because the Bush-Cheney team repeatedly deceived
Congress, the press and the public into believing that Saddam Hussein had
nuclear arms and other horrifying banned weapons that were an “imminent
threat” to the United States.

The administration also led the public to believe that Iraq was involved in
the 9/11 attacks – another blatant falsehood. Many times in recent years, I
have recalled Jefferson’s observation: “Indeed I tremble for my country
when I reflect that God is just.”

The basic strategy of the administration has been to encourage a climate of
fear, letting it exploit the 2001 al-Qaeda attacks not only to justify the
invasion of Iraq but also to excuse such dangerous misbehavior as the
illegal tapping of our telephones by government agents.

The same fear-mongering has led government spokesmen and cooperative
members of the press to imply that we are at war with the entire Arab and
Muslim world – more than a billion people.

Another shocking perversion has been the shipping of prisoners scooped off
the streets of Afghanistan to Guantanamo Bay, Cuba, and other countries
without benefit of our time-tested laws of habeas corpus.

Although the president was advised by the intelligence agencies last August
that Iran had no program to develop nuclear weapons, he continued to lie to
the country and the world.

This is the same strategy of deception that brought us into war in the
Arabian Desert and could lead us into an unjustified invasion of Iran.

I can say with some professional knowledge and experience that if Bush
invades yet another Muslim oil state, it would mark the end of U.S.
influence in the crucial Middle East for decades.

Ironically, while Bush and Cheney made counterterrorism the battle cry of
their administration, their policies – especially the war in Iraq – have
increased the terrorist threat and reduced the security of the United States.

Consider the difference between the policies of the first President Bush
and those of his son.

When the Iraqi army marched into Kuwait in August 1990, President George
H.W. Bush gathered the support of the entire world, including the United
Nations, the European Union and most of the Arab League, to quickly expel
Iraqi forces from Kuwait.

The Saudis and Japanese paid most of the cost.

Instead of getting bogged down in a costly occupation, the administration
established a policy of containing the Baathist regime with international
arms inspectors, no-fly zones and economic sanctions.

Iraq was left as a stable country with little or no capacity to threaten
others.

Today, after five years of clumsy, mistaken policies and U.S. military
occupation, Iraq has become a breeding ground of terrorism and bloody civil
strife.

It is no secret that former president Bush, his secretary of state, James
A. Baker III, and his national security adviser, Gen. Brent Scowcroft, all
opposed the 2003 invasion and occupation of Iraq.

In addition to the shocking breakdown of presidential legal and moral
responsibility, there is the scandalous neglect and mishandling of the
Hurricane Katrina catastrophe.

The veteran CNN commentator Jack Cafferty condenses it to a sentence: “I
have never ever seen anything as badly bungled and poorly handled as this
situation in New Orleans.”

Any impeachment proceeding must include a careful and critical look at the
collapse of presidential leadership in response to perhaps the worst
natural disaster in U.S. history.

Impeachment is unlikely, of course.

But we must still urge Congress to act.

Impeachment, quite simply, is the procedure written into the Constitution
to deal with presidents who violate the Constitution and the laws of the land.

It is also a way to signal to the American people and the world that some
of us feel strongly enough about the present drift of our country to
support the impeachment of the false prophets who have led us astray.

This, I believe, is the rightful course for an American patriot.

As former representative Elizabeth Holtzman, who played a key role in the
Nixon impeachment proceedings, wrote two years ago, “it wasn’t until the
most recent revelations that President Bush directed the wiretapping of
hundreds, possibly thousands, of Americans, in violation of the Foreign
Intelligence Surveillance Act (FISA) – and argued that, as Commander in
Chief, he had the right in the interests of national security to override
our country’s laws – that I felt the same sinking feeling in my stomach as
I did during Watergate…

A President, any President, who maintains that he is above the law – and
repeatedly violates the law – thereby commits high crimes and misdemeanors.”

I believe we have a chance to heal the wounds the nation has suffered in
the opening decade of the 21st century.

This recovery may take a generation and will depend on the election of a
series of rational presidents and Congresses.

At age 85, I won’t be around to witness the completion of the difficult
rebuilding of our sorely damaged country, but I’d like to hold on long
enough to see the healing begin.

There has never been a day in my adult life when I would not have
sacrificed that life to save the United States from genuine danger, such as
the ones we faced when I served as a bomber pilot in World War II.

We must be a great nation because from time to time, we make gigantic
blunders, but so far, we have survived and recovered.

Year in Film: Things we lost in the theater

The economy: Apocalypse Now — or at least soon. Iraq: No End in Sight. Israel: "Putting Out Fire with Gasoline (Theme from Cat People)." China, in its role as the principal backer of our colossal national debt: I Spit on Your Grave. Our president: National Lampoon’s Permanent Vacation.

In 2007, as life increasingly resembled lurid or delusional fiction, movies stepped up to the social-responsibility plate and started presenting a franker version of reality.

That is, the movies nobody saw.

The ones everyone did see, in quantifiable box office terms, were Spider-Man 3, Shrek the Third, the third Bourne and Pirates flicks, a fifth Harry Potter, and … Transformers. In other words, movies whose major reference points are other movies, comic books, and video games. (The Bourne films are refreshingly low-CGI, but they offer only a pretense of institutional critique.) If most multiplex patrons’ level of caring or knowledge about international and domestic politics was turned into a film, it could be titled Whatever-Man 3.

The summer — that silly season of things blowing up and boob jokes — is likely to spread even wider across the calendar henceforth, because this fall and winter offered serious year-end awards-bait stuff, and nobody wanted it.

Europeans have branded this the best year for United States cinema in a long time. But the ambitious, uncompromising two-and-a-half-hour-plus dramas released late in the year — 1970s ambling-epic throwbacks such as The Assassination of Jesse James by the Coward Robert Ford, Into the Wild, and There Will Be Blood — are against-the-wind efforts. Even intelligent dramas wrapped in easy-access thriller form, like Eastern Promises, Michael Clayton, Zodiac, Rescue Dawn, and Gone Baby Gone, have attracted few takers. (You could deem the long, self-important American Gangster an exception, were it not so derivative. Check out Larry Cohen’s 1973 Black Caesar.)

Commercially speaking, this fall’s glut of somber dramas — including Before the Devil Knows You’re Dead, Things We Lost in the Fire, Reservation Road, We Own the Night, and Lions for Lambs — collapsed like a row of dominoes. Their failure was variously blamed on an overcrowded marketplace and being pushed prematurely off screens by the latest CGI extravaganzas. Several of them just weren’t good, but even the best expired quickly.

Two films likely to face off for Academy Awards, No Country for Old Men and Atonement, have drawn larger numbers, though in their different ways neither has much to say about the world we live in now. No Country turns a minor Cormac McCarthy novel into a major Coen brothers effort that’s still just a great genre piece at the end of the day. Atonement turns a brilliant Ian McEwan novel into a sumptuous Merchant-Ivory-like affair, muffling the book’s bitter heart.

Every movie that did try to wrestle with our extremely precarious, morally compromised place in the scheme of things basically tanked. Maybe that’s less surprising than the fact that so many filmmakers actually got to make works dealing in one way or another with the current American realpolitik, if only on the relatively neutral, empathetic trickle-down level of grieving military spouses (Grace Is Gone), traumatized soldiers readjusting to civilian life (Home of the Brave), or World Trade Center widowers (Reign Over Me).

The Crash crowd shunned scenarist Paul Haggis’s much better (though not politically daring or even pointed) second film as director, In the Valley of Elah. It fictionalizes a real-life case (Iraq vet Richard Davis’s 2003 murder), as did Brian De Palma’s Redacted, drawn from a 2006 incident in which several US soldiers gang-raped a 14-year-old Iraqi girl and then killed her entire family. An atrocious movie because of its ill-chosen mockumentary form, loutish tone, and garbled message, Redacted ironically attracted widespread notice due to the loud protestations of Bill O’Reilly and other conservative pundits who proclaimed it treasonous. They didn’t say it was fraudulent — as Republican saint Ronald Reagan once told us, "Facts are stupid things."

Despite the lure of Angelina Jolie and the publicity stumping of her producer–spouse–love slave Brad Pitt, Michael Winterbottom’s more overtly fact-based A Mighty Heart — about kidnapped Wall Street Journal reporter Daniel Pearl’s murder by Pakistani jihadists — got no audience love. Ditto Rendition, with America’s sweetheart Reese Witherspoon as another agitating spouse with a missing husband, this one an Egyptian-born US citizen imprisoned and tortured by the CIA on dubious terrorism charges.

That the year’s better feel-bad dramas didn’t take off despite their star power is disappointing, if not unexpected. But it truly depresses that Charles Ferguson’s No End in Sight, the year’s best documentary — and arguably best movie, period — failed to break out despite universal raves. This engrossing, incendiary, genuinely balanced chronicle of how the George W. Bush administration destroyed and betrayed Iraq — and probably doomed everyone to a general fucked-up-ness only global warming might trump — doesn’t even bother indicting the reasons we attacked in the first place. It’s busy enough simply detailing the arrogance and ineptitude that have turned our supposed reconstruction of the nation into a lit match hovering beside the tinder of pissed-off former allies worldwide.

No End in Sight should have been a must-see that marshaled voter-taxpayer opposition to the freaks in the seats of power. It should at least have ignited as much enthusiastic outrage as An Inconvenient Truth and Fahrenheit 9/11. But it was an intended bombshell that landed like a softball on Astroturf.

There are a few more politically charged movies in the pipeline, notably director Kimberly Peirce’s first feature since Boys Don’t Cry, Stop Loss. But given the commercial cold shoulder such films have received lately, what can we expect from a post–writers’ strike Hollywood that will be looking to restore its brief income slowdown as safely as possible? Gems like Norbit, Because I Said So, Bratz, Good Luck Chuck, Daddy Day Camp, National Treasure: Book of Secrets, Halloween, I Now Pronounce You Chuck and Larry, License to Wed, Saw IV, and Wild Hogs — not to mention the three- to fivequels. Even when those movies bombed, they landed softly enough (often redeemed by profitable DVD releases) to affirm the wisdom of sticking to strict formulas.

Escapism: good. Wholesale obliviousness: better. Will there be a 2010 equivalent to 2007’s finest narrative flick, The Assassination of Jesse James (estimated cost: $30 million; domestic gross: $3 million, despite a career-best Brad Pitt)? Not likely.

Up against the wall

There’s a new mural at 24th and Capp streets that does a stellar job of capturing the urban, cultural vibe of the Mission’s residents. No, not the skinny jeans–wearing, Burning Man bohemians who’ve colonized the area in recent years. I’m talking the baggy jeans–wearing Latino youths who are the inheritors of a proud local tradition of Chicano mural art. Craftily melding urban motifs, the mural celebrates their bicultural realities: lowriders cruise alongside hyphy "scrapers," pachucos and Mac Dre mingle, and graffiti lettering makes the same statement as silk-screened Brown Pride posters of the ’70s.

The work was created from July to September by members of Homies Organizing the Mission to Empower Youth, a neighborhood-based youth leadership nonprofit serving at-risk Latino teens and young adults. The primary goal of HOMEY is violence prevention. Through art, education, and skill-building activities, the organization offers alternatives to young people growing up in a rough environment where gangbanging, drug dealing, gun violence, and incarceration are the norm.

The mural is a shining example of the numerous creative projects initiated by HOMEY to bring together young folks who might otherwise have beef or get caught up in the neighborhood’s dangerous Sureño-Norteño turf rivalry. According to HOMEY project coordinator Nancy Hernandez, the mural bolstered the organization’s other violence-prevention efforts because "young people who didn’t know each other got to know each other. People in the community who didn’t know each other got to know each other. And people were educated on a lot of things to be proud of about their culture, their history, and their neighborhood." Although a core group of teen and adult artists executed the initial planning and design for the mural, in the end more than 200 community members contributed to the painting.

The title of the piece is Solidarity: Breaking Down Barriers. Taking unity as a starting point, the artists began by brainstorming about the influences that divide people, communities, and cultures: everything from national boundaries to gang-affiliated colors. No national flags appear in the 100-foot-long painting. The United States–Mexico border wall figures prominently, snaking through the background of the mural’s central panels, but it’s juxtaposed with portrayals of intra- and interethnic alliance in the foreground. Mexican Revolucionarios, members of the United Farm Workers, and Brown Berets, all painted in sepia tones, float beneficently behind modern-day Raza activists wearing white tees and white bandanas — a purposefully neutral color worn nationwide by Latino youths during the immigrant rights rallies of May 1. In the Bay Area, many of those activists were HOMEY members.

As celebratory as the painting is, one controversial panel on its far right-hand side threatened to overshadow the entire project. It’s a portrayal of Palestinians garbed in traditional Arab kaffiyeh head scarves breaking through a concrete wall — ostensibly the Israeli West Bank security barrier. The image fits into a third-world rights vignette expressing solidarity with indigenous groups and colonized peoples.

Some members of San Francisco’s Jewish community took issue with the image, which originally included a hole in the wall in the shape of the state of Israel. Two Jewish advocacy groups, the Jewish Community Relations Council and the Anti-Defamation League, brought these concerns to the San Francisco Arts Commission, the board charged with approving all public art. "We thought this one panel was disjointed from the rest of the mural," JCRC associate director Abby Michelson Porth recalls telling HOMEY and the Arts Commission at a public forum this August. "It didn’t demonstrate peaceful coexistence, which is, frankly, contrary to the theme of the work."

Rather than battle it out and fling loaded accusations of censorship and anti-Zionism at each other — which would indeed completely contradict the intent of the community-building project — the two factions engaged in a civil dialogue that turned out to be a learning experience for all. HOMEY agreed to make some changes to the imagery: the kaffiyeh shrouding one figure’s face, which the JCRC and the ADL claimed connoted terrorism, is now pulled back and worn as a simple Muslim head scarf; the wall opening now breaks into an expansive blue sky; and the branches of an olive tree now weave around the wall — a symbol of peace and a near-literal olive branch. Still, according to Porth, "It’s not the imagery that we would choose, but we recognize the muralists made significant changes and that they came far from the original design."

Hernandez is quick to point out that many Jewish San Franciscans supported the original design and that several of the artists are in fact Jewish. But she acknowledges that "when we’re painting somebody else’s culture, we have to be humble. We have to say, ‘You know what? We don’t know everything about everybody, but we do know about ourselves, and we’re trying to draw parallels between ourselves and other peoples.’<0x2009>"

To many, it may come as a surprise that the mural’s Palestinian imagery was so controversial. After all, claiming solidarity with Palestine is a common stance among San Francisco’s radical left. Nonetheless, by giving their input, the mural’s detractors wound up being collaborators on a project authored by, as it turned out, truly disparate voices in the community.

An Appeal to Barack Obama

“The Democrats have been stuck in the arguments of Vietnam, which means that either you’re a Scoop Jackson Democrat or you’re a Tom Hayden Democrat and you’re suspicious of any military action. And that’s just not my framework.” – Sen. Barack Obama.

Barack, I thought Hillary Clinton was known as the Great Triangulator, but you are learning well. The problem with setting up false polarities to position yourself in the “center”, however, is that it’s unproductive both politically and intellectually.

Politically, it is a mistake because there last time I looked there were a whole lot more “Tom Hayden Democrats” voting in the California primary and, I suspect, around the country, than “‘Scoop’ Jackson Democrats.” In fact, they are your greatest potential base, aside from African-American voters, in a multi-candidate primary.

More disturbing is what happens to the mind by setting up these polarities. To take a “centrist” position, one calculates the equal distance between two “extremes.” It doesn’t matter if one “extreme” is closer to the truth. All that matters is achieving the equidistance. This means the presumably “extreme” view is prevented from having a fair hearing, which would require abandoning the imaginary center. And it invites the “extreme” to become more “extreme” in order to pull the candidate’s thinking in a more progressive direction. The process of substantive thinking is corroded by the priority of political positioning.

I have been enthused by the crowds you draw, by the excitement you instill in my son and daughter-in-law, by the seeds of inspiration you plant in our seven-year old [biracial] kid. I love the alternative American narrative you weave on the stump, one in which once-radical social movements ultimately create a better America step by step. I very much respect your senior advisers like David Axelrod, who figured out a way to elect Harold Washington mayor of Chicago. You are a truly global figure in this age of globalization.

But as the months wear on, I see a problem of the potential being squandered. Hillary Clinton already occupies the political center. John Edwards holds the populist labor/left. And that leaves you with a transcendent vision in search of a constituency.

Your opposition to the Iraq War could have distinguished you, but it became more parsed than pronounced. All the nuance might please the New York Times’ Michael Gordon, who helped get us into this madness in the first place, but the slivers of difference appear too narrow for many voters to notice. Clinton’s plan, such as it is, amounts to six more years of thousands of American troops in Iraq [at least]. Your proposal is to remove combat troops by mid-2010, while leaving thousands of advisers trying to train a dysfunctional Iraqi army, and adding that you might re-invade to stave off ethnic genocide. Lately, you have said the mission of your residual American force would be more limited than the Clinton proposal. You would commit trainers, for example, only if the Iraqi government engages in reconciliation and abandons sectarian policing. You would not embed American trainers in the crossfire of combat. This nuancing avoids the tough and obvious question of what to do with the sectarian Frankenstein monster we have funded, armed and trained in the Baghdad Interior Ministry. The Jones Commission recently proposed “scrapping” the Iraqi police service. Do you agree? The Center for American Progress, directed by Bill Clinton’s former chief of staff, is urging that all US troops, including trainers, be redeployed this year. Why do you disagree? Lately you have taken advantage of Hillary Clinton’s hawkishness on Iran to oppose bombing that country without Congressional authorization. But you carefully decline to say whether you would support bombing Iran when and if the time comes.

This caution has a history:

– you were against the war in 2002 because it was a “dumb war”,
but you had to point out that you were not against all wars, without
exactly saying what wars you favored;

– then you visited Iraq for 36 hours and “could only marvel at
the ability of our government to essentially erect entire cities
within hostile territory”;

– then as the quagmire deepened, you cloaked yourself in the
bipartisan mantle of the Baker-Hamilton Study Group, which advocated
leaving thousands of American troops in Iraq to fight terrorism, train
the Iraqis until they “stand up”, and sundry other tasks of
occupation;

Perhaps your national security advisers are getting to you when it should be the other way around. Their expertise is not in the politics of primaries. If anything, they reject the of populist peace pressure influencing elite national security decisions. The result is a frustration towards all the Democratic candidates for what the Center for American Progress has recently called “strategic drift.” The political result is the danger of returning to John Kerry’s muffled message in 2004. The policy result may be a total security disaster for our country, draining our young soldiers’ blood and everyone’s taxes on the continuing degradation of our national honor in a war which cannot be won.

Just for the record, let me tell you my position on Iraq. I think the only alternative is to begin a global diplomatic peace offensive starting with a commitment to withdraw all our troops as rapidly as possible. That is the only way to engage the world, including the Iraqi factions, in doing something about containing the crises of refugees, reconciliation and reconstruction. It means negotiating with Iran rather than escautf8g to a broader war. If you want to “turn a new page”, it should not be about leaving the Sixties behind. It will be about leaving behind the superpower fantasies of both the neo-conservatives and your humanitarian hawks. And yes, it is to be “suspicious”, as Eisenhower and John Kennedy came to be suspicious, of the advice of any Wise Men or security experts who advocated the military occupation of Iraq. Is that position as extreme as your rhetoric assumes?

Your problem, if I may say so out loud, and with all respect, is that the deepest rationale for your running for president is the one that you dare not mention very much, which is that you are an African-American with the possibility of becoming president. The quiet implication of your centrism is that all races can live beyond the present divisions, in the higher reality above the dualities. You may be right. You see the problems Hillary Clinton encounters every time she implies that she wants to shatter all those glass ceilings and empower a woman, a product of the feminist movement, to be president? Same problem. So here’s my question: how can you say let’s “turn the page” and leave all those Sixties’ quarrels behind us if we dare not talk freely in public places about a black man or a woman being president? Doesn’t that reveal that on some very deep level that we are not yet ready to “turn the page”?

When you think about it, these should be wonderful choices, not forbidden topics. John Edwards can’t be left out either, for his dramatic and, once again, unstated role as yet another reformed white male southerner seeking America’s acceptance, like Carter, Clinton and Gore before him. Or Bill Richardson trying to surface the long-neglected national issues of Latinos. I think these all these underlying narratives, of blacks, women, white southerners and la raza – excuse me, Hispanic-Americans – are far more moving, engaging and electorally-important than the dry details of policy.

What I cannot understand is your apparent attempt to sever, or at least distance yourself, from the Sixties generation, though we remain your single greatest supporting constituency. I can understand, I suppose, your need to define yourself as a American rather than a black American, as if some people need to be reassured over and over. I don’t know if those people will vote for you.

You were ten years old when the Sixties ended, so it is the formative story of your childhood. The polarizations that you want to transcend today began with life-and-death issues that were imposed on us. No one chose to be “extreme” or “militant” as a lifestyle preference. It was an extreme situation that produced us. On one side were armed segregationists, on the other peaceful black youth. On one side were the destroyers of Vietnam, on the other were those who refused to
submit to orders. On the one side were those keeping women in inferior roles, on the other were those demanding an equal rights amendment. On one side were those injecting chemical poisons into our rivers, soils, air and blood streams, on the other were the defenders of the natural world. On one side were the perpetrators of big money politics, on the other were keepers of the plain democratic tradition. Does anyonebelieve those conflicts are behind us?

I can understand, in my old age, someone wanting to dissociate from the extremes to which some of us were driven by the times. That seems to be the ticket to legitimacy in the theater of the media and cultural gatekeepers. I went through a similar process in 1982 when I ran for the legislature, reassuring voters that I wasn’t “the angry young man that I used to be.” I won the election, and then the Republicans objected to my being seated anyway! Holding the idea that the opposites of the Sixties were equally extreme or morally equivalent is to risk denying where you came from and what made your opportunities possible. You surely understand that you are one of the finest descendants of the whole Sixties generation, not some hybrid formed by the clashing opposites of that time. We want to be proud of the role we may have played in all you have become, and not be considered baggage to be discarded on your ascent. You recognize this primal truth when you stand on the bridge in Selma, Alabama, basking in the glory of those who were there when you were three years old. But you can’t have it both ways, revering the Selma march while trying to “turn the page” on the past.

This brings me back to why you want to stand in the presumed center against the “Tom Hayden Democrats.” Are you are equally distant from the “George McGovern Democrats.”, and the “Jesse Jackson Democrats”? How about the “Martin Luther King Democrats”, the “Cesar Chavez Democrats”, the “Gloria Steinem Democrats”? Where does it end?

What about the “Bobby Kennedy Democrats”? I sat listening to you last year at an RFK human rights event in our capital. I was sitting behind Ethel Kennedy and several of her children, all of whom take more progressive stands than anyone currently leading the national Democratic Party. They were applauding you, supporting your candidacy, and trying to persuade me that you were not just another charismatic candidate but the one we have been waiting for.

Will you live up to the standard set by Bobby Kennedy in 1968? He who sat with Cesar Chavez at the breaking of the fast, he who enlisted civil rights and women activists in his crusade, who questioned the Gross National Product as immoral, who dialogued with people like myself about ending the war and poverty? Yes, Bobby appealed to cops and priests and Richard Daley too, but in 1968 he never distanced himself from the dispossessed, the farmworkers, the folksingers, the war resisters, nor the poets of the powerless. He walked among us.

The greatest gift you have been given by history is that as the elected tribune of a revived democracy, you could change America’s dismal role in the world. Because of what you so eloquently represent, you could convince the world to give America a new hearing, even a new respect. There are no plazas large enough for the crowds that would listen to your every word, wondering if you are the one the whole world is waiting for. They would not wait for long, of course. But they would passionately want to give you the space to reset the American direction.

What is the risk, after all? If “think globally, act locally” ever made any sense, this is the time, and you are the prophet. If you want to be mainstream, look to the forgotten mainstream. You don’t even have to leave the Democratic Party. It’s time to renew the best legacy of the Good Neighbor policy of Roosevelt before it dissolved into the Cold War, the Strangelove priesthood, the CIA coups in Iran and Guatemala, the sordid Bay of Pigs, the open graves of Vietnam. It’s time to renew the best legacy of the New Deal before it became Neo-Liberalism, and finally achieve the 1948 Democratic vision of national health care.

May you – and Hillary too – live up to the potential, the gift of the past, prepared for you in the dreams not only of our fathers, but of all those generations with hopes of not being forgotten.

The title of Barbet Schroeder’s new documentary, Terror’s Advocate, evokes Keanu Reeves’s role as Kevin Lomax, a lawyer seduced by Satan (Al Pacino) in 1997’s The Devil’s Advocate. Reeves’s character crosses the line into evil when he gets a child molester off on a technicality; next thing you know, he’s living in Manhattan, making big bucks, and being seduced by the lesbian minions of Satan in an elevator while his wife (Charlize Theron) has her womb ripped out. In Terror’s Advocate we follow the equally colorful career of lawyer Jacques Vergès, which begins with ideological and erotic clarity — defending gorgeous Algerian bombers during their struggle for independence from France — but spirals into mystery and monstrosity.

The point where Vergès crosses the line that leads him into relationships with dictators, Nazis, and Carlos the Jackal is less distinct than the line crossed by Reeves’s lawyer in The Devil’s Advocate. Schroeder frames Vergès’s story as a mirror of the recent history of terrorism in Europe, with attention to all of the ambiguity that term implies. If one person’s terrorist is another’s freedom fighter and the term itself a strategy to disparage the warfare of those without governments, it doesn’t follow that every act of terror is ethically equivalent. "There’s a magnificent, heroic heart, which is Algeria," Schroeder has said, discussing the film. "This is the matrix, the place where our lead character finds himself, reveals himself, and experiences the most intense moments of his life…. All of this is something very beautiful, very pure: an ideal."

On Armistice Day in 1945, the French massacred 10,000 to 45,000 Algerians for waving their flags. During the years that followed, Algerian attempts to purge their boorish occupiers would include blowing up European establishments in the African capital. In 1957, Djamila Bouhired was found guilty of placing a bomb in the Milk Bar and condemned to death. She became an international sensation, partially through the inspired efforts of her lawyer — Vergès. He developed what became known as the rupture defense — instead of having his clients apologize or plead for mercy, he provoked the opposition and used the trial to redefine the terms of the debate, calling attention to the French use of torture.

His tactics paid off. Bouhired was pardoned and released from prison, after which she returned to Algeria and married Vergès. But in the ’70s he abandoned her and his children and vanished for eight years under circumstances that remain unclear, despite Terror’s Advocate‘s sometimes tedious examination of that narrative gap. By the time Vergès finally reappeared, the lines had begun to blur — between political action and sociopathic adventuring, between terrorism and foreplay. One of Schroeder’s most inspired subtexts is that organized violence, whether state sponsored or revolutionary, offers an arena for unconventional erotic pleasures, such as rape, torture, or simply rescuing sexy women involved in the deaths of others — like Bouhired or Vergès’s other great love, Magdalena Kopp, girlfriend of Carlos the Jackal.

In Reversal of Fortune (1990), Schroeder fictionalized the relationship between Claus von Bülow and Alan Dershowitz, the lawyer who defended him against charges that he’d lethally poisoned his wife. Did von Bülow get away with murder or was he innocent and akin to Frankenstein’s monster at the hands of the lynch mob? Schroeder has always been interested in monsters — his documentary subjects include Idi Amin, Charles Bukowski, and Koko the gorilla — and drawn to moral ambiguity, the seductive power of evil, and the erotic appeal of violence. Combine Before and After (1995), Our Lady of the Assassins (2000) and Murder by Numbers (2002), and you have an oeuvre with more murderous teenage boys than anything this side of William Burroughs. In his Single White Female (1992), Kiss of Death (1994), and Desperate Measures (1997) there is a twinship between monsters and heroes and a surprising sympathy for the violently unhinged. Consistently, Schroeder examines people of conscience who are seduced into doing evil’s bidding, and he lets them speak for themselves. Even Vergès’s defense of Nazi butcher Klaus Barbie is framed as an opportunity to attack French hypocrisy, imperialism, and butchery. Asked if he’d defend Hitler, Vergès says, "I’d even agree to defend [George W.] Bush. But only if he agrees to plead guilty."

Terror’s Advocate is dense with information. Its structure is complex and indirect and requires unfaltering attention. Yet Schroeder succeeds at creating a surprising amount of suspense, especially considering the amount of screen time given over to talking heads. Meanwhile, he quietly explores what must be one of the central enigmas for our tortured planet, the human relationship to violence. Violence and money, violence and sex, violence and political change, senseless violence and goal-oriented violence — Schroeder nimbly navigates all of the above, creating a visceral ethical disquiet. *

There are a handful of freedoms that have almost always been a part of American democracy. Even when they didn’t exactly apply to everyone or weren’t always protected by the people in charge, a few simple but significant rights have been patently clear in the Constitution: You can’t be nabbed by the cops and tossed behind bars without a reason. If you are imprisoned, you can’t be incarcerated indefinitely; you have the right to a speedy trial with a judge and jury. When that court date rolls around, you’ll be able to see the evidence against you.

The president can’t suspend elections, spy without warrants, or dispatch federal troops to trump local cops or quell protests. Nor can the commander in chief commence a witch hunt, deem individuals "enemy combatants," or shunt them into special tribunals outside the purview of our 218-year-old judicial system.

Until now. This year’s Project Censored presents a chilling portrait of a newly empowered executive branch signing away civil liberties for the sake of an endless and amorphous war on terror. And for the most part, the major news media weren’t paying attention.

"This year it seemed like civil rights just rose to the top," said Peter Phillips, the director of Project Censored, the annual media survey conducted by Sonoma State University researchers and students who spend the year patrolling obscure publications, national and international Web sites, and mainstream news outlets to compile the 25 most significant stories that were inadequately reported or essentially ignored.

While the project usually turns up a range of underreported issues, this year’s stories all fall somewhat neatly into two categories — the increase of privatization and the decrease of human rights. Some of the stories qualify as both.

"I think they indicate a very real concern about where our democracy is heading," writer and veteran judge Michael Parenti said.

For 31 years Project Censored has been compiling a list of the major stories that the nation’s news media have ignored, misreported, or poorly covered.

The Oxford American Dictionary defines censorship as "the practice of officially examining books, movies, etc., and suppressing unacceptable parts," which Phillips said is also a fine description of what happens under a dictatorship. When it comes to democracy, the black marker is a bit more nuanced. "We need to broaden our understanding of censorship," he said. After 11 years at the helm of Project Censored, Phillips thinks the most bowdlerizing force is the fourth estate itself: "The corporate media is complicit. There’s no excuse for the major media giants to be missing major news stories like this."

As the stories cited in this year’s Project Censored selections point out, the federal government continues to provide major news networks with stock footage, which is dutifully broadcast as news. The George W. Bush administration has spent more federal money than any other presidency on public relations. Without a doubt, Parenti said, the government invests in shaping our beliefs. "Every day they’re checking out what we think," he said. "The erosion of civil liberties is not happening in one fell swoop but in increments. Very consciously, this administration has been heading toward a general autocracy."

Carl Jensen, who founded Project Censored in 1976 after witnessing the landslide reelection of Richard Nixon in 1972 in spite of mounting evidence of the Watergate scandal, agreed that this year’s censored stories amount to an accumulated threat to democracy. "I’m waiting for one of our great liberal writers to put together the big picture of what’s going on here," he said.

1. GOOD-BYE, HABEAS CORPUS


The Military Commissions Act, passed in September 2006 as a last gasp of the Republican-controlled Congress and signed into law by Bush that Oct. 17, made significant changes to the nation’s judicial system.

The law allows the president to designate any person an "alien unlawful enemy combatant," shunting that individual into an alternative court system in which the writ of habeas corpus no longer applies, the right to a speedy trial is gone, and justice is meted out by a military tribunal that can admit evidence obtained through coercion and presented without the accused in the courtroom, all under the guise of preserving national security.

Habeas corpus, a constitutional right cribbed from the Magna Carta, protects against arbitrary imprisonment. Alexander Hamilton, writing in the Federalist Papers, called it the greatest defense against "the favorite and most formidable instruments of tyranny."

The Military Commissions Act has been seen mostly as a method for dealing with Guantánamo Bay detainees, and most journalists have reported that it doesn’t have any impact on Americans. On Oct. 19, 2006, editors at the New York Times wrote, in quite definitive language, "this law does not apply to American citizens."

Investigative journalist Robert Parry disagrees. The right of habeas corpus no longer exists for any of us, he wrote in the online journal Consortium. Deep down in the lower sections of the act, the language shifts from the very specific "alien unlawful enemy combatant" to the vague "any person subject to this chapter."

"Why does it contain language referring to ‘any person’ and then adding in an adjacent context a reference to people acting ‘in breach of allegiance or duty to the United States’?" Parry wrote. "Who has ‘an allegiance or duty to the United States’ if not an American citizen?"

Reached by phone, Parry told the Guardian that "this loose phraseology could be interpreted very narrowly or very broadly." He said he’s consulted with lawyers who are experienced in drafting federal security legislation, and they agreed that the "any person" terminology is troubling. "It could be fixed very simply, but the Bush administration put through this very vaguely worded law, and now there are a lot of differences of opinion on how it could be interpreted," Parry said.

Though US Sens. Patrick Leahy (D-Vt.) and Arlen Specter (R-Pa.) moved quickly to remedy the situation with the Habeas Corpus Restoration Act, that legislation has yet to pass Congress, which some suspect is because too many Democrats don’t want to seem soft on terrorism. Until tested by time, exactly how much the language of the Military Commissions Act may be manipulated will remain to be seen.

2. MARTIAL LAW: COMING TO A TOWN NEAR YOU


The Military Commissions Act was part of a one-two punch to civil liberties. While the first blow to habeas corpus received some attention, there was almost no media coverage of a private Oval Office ceremony held the same day the military act was signed at which Bush signed the John Warner Defense Authorization Act, a $532 billion catchall bill for defense spending.

Tucked away in the deeper recesses of that act, section 1076 allows the president to declare a public emergency and dispatch federal troops to take over National Guard units and local police if he determines them unfit for maintaining order. This is essentially a revival of the Insurrection Act, which was repealed by Congress in 1878, when it passed the Posse Comitatus Act in response to Northern troops overstaying their welcome in the reconstructed South. That act wiped out a potentially tyrannical amount of power by reinforcing the idea that the federal government should patrol the nation’s borders and let the states take care of their own territories.

The Warner act defines a public emergency as a "natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any state or possession of the United States" and extends its provisions to any place where "the president determines that domestic violence has occurred to such an extent that the constituted authorities of the state or possession are incapable of maintaining public order." On top of that, federal troops can be dispatched to "suppress, in a state, any insurrection, domestic violence, unlawful combination, or conspiracy."

So everything from a West Nile virus outbreak to a political protest could fall into the president’s personal definition of mayhem. That’s right — put your picket signs away.

The Warner act passed with 90 percent of the votes in the House and cleared the Senate unanimously. Months after its passage, Leahy was the only elected official to have publicly expressed concern about section 1076, warning his peers Sept. 19, 2006, that "we certainly do not need to make it easier for presidents to declare martial law. Invoking the Insurrection Act and using the military for law enforcement activities goes against some of the central tenets of our democracy. One can easily envision governors and mayors in charge of an emergency having to constantly look over their shoulders while someone who has never visited their communities gives the orders." In February, Leahy introduced Senate Bill 513 to repeal section 1076. It’s currently in the Armed Services Committee.

3. AFRICOM


President Jimmy Carter was the first to draw a clear line between America’s foreign policy and its concurrent "vital interest" in oil. During his 1980 State of the Union address, he said, "An attempt by any outside force to gain control of the Persian Gulf region will be regarded as an assault on the vital interests of the United States of America, and such an assault will be repelled by any means necessary, including military force."

Under what became the Carter Doctrine, an outpost of the Pentagon, called the United States Central Command, or CENTCOM, was established to ensure the uninterrupted flow of that slick "vital interest."

The United States is now constructing a similar permanent base in Africa, an area traditionally patrolled by more remote commands in Europe and the Pacific. No details have been released about exactly what AFRICOM’s operations and responsibilities will be or where troops will be located, though government spokespeople have vaguely stated that the mission is to establish order and keep peace for volatile governments — that just happen to be in oil-rich areas.

Though the official objective may be peace, some say the real desire is crude. "A new cold war is under way in Africa, and AFRICOM will be at the dark heart of it," Bryan Hunt wrote on the Moon of Alabama blog, which covers politics, economics, and philosophy. Most US oil imports come from African countries — in particular, Nigeria. According to the 2007 Congressional Budget Justification for Foreign Operations, "disruption of supply from Nigeria would represent a major blow to US oil-security strategy."

Though details of the AFRICOM strategy remain secret, Hunt has surveyed past governmental statements and reports by other independent journalists to draw parallels between AFRICOM and CENTCOM, making the case that the United States sees Africa as another "vital interest."

4. SECRET TRADE AGREEMENTS


As disappointing as the World Trade Organization has been, it has provided something of an open forum in which smaller countries can work together to demand concessions from larger, developed nations when brokering multilateral agreements.

At least in theory. The 2006 negotiations crumbled when the United States, the European Union, and Australia refused to heed India’s and Brazil’s demands for fair farm tariffs.

In the wake of that disaster, bilateral agreements have become the tactic of choice. These one-on-one negotiations, designed by the US and the EU, are cut like backroom deals, with the larger country bullying the smaller into agreements that couldn’t be reached through the WTO.

Bush administration officials, always quick with a charming moniker, are calling these free-trade agreements "competitive liberalization," and the EU considers them essential to negotiating future multilateral agreements.

But critics see them as fast tracks to increased foreign control of local resources in poor communities. "The overall effect of these changes in the rules is to progressively undermine economic governance, transferring power from governments to largely unaccountable multinational firms, robbing developing countries of the tools they need to develop their economies and gain a favorable foothold in global markets," states a report by Oxfam International, the antipoverty activist group.

5. SHANGHAIED SLAVES CONSTRUCT US EMBASSY IN IRAQ


Part of the permanent infrastructure the United States is erecting in Iraq includes the world’s largest embassy, built on Green Zone acreage equal to that of Vatican City. The $592 million job was awarded in 2005 to First Kuwaiti Trading and Contracting. Though much of the project’s management is staffed by Americans, most of the workers are from small or developing countries like the Philippines, India, and Pakistan and, according to David Phinney of CorpWatch — a Bay Area organization that investigates and exposes corporate environmental crimes, fraud, corruption, and violations of human rights — are recruited under false pretenses. At the airport, their boarding passes read Dubai. Their passports are stamped Dubai. But when they get off the plane, they’re in Baghdad.

Once on site, they’re often beaten and paid as little as $10 to $30 a day, CorpWatch concludes. Injured workers are dosed with heavy-duty painkillers and sent back on the job. Lodging is crowded, and food is substandard. One ex-foreman, who’s worked on five other US embassies around the world, said, "I’ve never seen a project more fucked up. Every US labor law was broken."

These workers have often been banned by their home countries from working in Baghdad because of unsafe conditions and flagging support for the war, but once they’re on Iraqi soil, protections are few. First, Kuwaiti managers take their passports, which is a violation of US labor laws. "If you don’t have a passport or an embassy to go to, what do you do to get out of a bad situation?" asked Rory Mayberry, a former medic for one of First Kuwaiti’s subcontractors, who blew the whistle on the squalid living conditions, medical malpractice, and general abuse he witnessed at the site.

The Pentagon has been investigating the slavelike conditions but has not released the names of any vioutf8g contractors or announced penalties. In the meantime, billions of dollars in contracts continue to be awarded to First Kuwaiti and other companies at which little accountability exists. As Phinney reported, "No journalist has ever been allowed access to the sprawling 104-acre site."

6. FALCON’S TALONS


Operation FALCON, or Federal and Local Cops Organized Nationally, is, in many ways, the manifestation of martial law forewarned by Frank Morales (see story 2). In an unprecedented partnership, more than 960 federal, state, and local police agencies teamed up in 2005 and 2006 to conduct the largest dragnet raids in US history. Armed with fistfuls of arrest warrants, they ran three separate raids around the country that netted 30,110 criminal arrests.

The Justice Department claimed the agents were targeting the "worst of the worst" criminals, and Attorney General Alberto Gonzales said, "Operation FALCON is an excellent example of President Bush’s direction and the Justice Department’s dedication to deal both with the terrorist threat and traditional violent crime."

However, as writer Mike Whitney points out on Uruknet.info, none of the suspects has been charged with anything related to terrorism. Additionally, while 30,110 individuals were arrested, only 586 firearms were found. That doesn’t sound very violent either.

Though the US Marshals Service has been quick to tally the offenses, Whitney says the numbers just don’t add up. For example, FALCON in 2006 captured 462 violent sex-crime suspects, 1,094 registered sex offenders, and 9,037 fugitives.

What about the other 7,481 people? "Who are they, and have they been charged with a crime?" Whitney asked.

The Marshals Service remains silent about these arrests. Whitney suggests those detainees may have been illegal immigrants and may be bound for border prisons currently being constructed by Halliburton (see last year’s Project Censored).

As an added bonus of complicity, the Justice Department supplied local news outlets with stock footage of the raids, which some TV stations ran accompanied by stories sourced from the Department of Justice’s news releases without any critical coverage of who exactly was swept up in the dragnets and where they are now.

7. BLACKWATER


The outsourcing of war has served two purposes for the Bush administration, which has given powerful corporations and private companies lucrative contracts supplying goods and services to American military operations overseas and quietly achieved an escalation of troops beyond what the public has been told or understands. Without actually deploying more military forces, the federal government instead contracts with private security firms like Blackwater to provide heavily armed details for US diplomats in Iraq, Afghanistan, and other countries where the nation is currently engaged in conflicts.

Blackwater is one of the more successful and well connected of the private companies profiting from the business of war. Started in 1996 by an ex–Navy Seal named Erik Prince, the North Carolina company employs 20,000 hired guns, training them on the world’s largest private military base.

"It’s become nothing short of the Praetorian Guard for the Bush administration’s so-called global war on terror," author Jeremy Scahill said on the Jan. 26 broadcast of the TV and radio news program Democracy Now! Scahill’s Blackwater: The Rise of the World’s Most Powerful Mercenary Army was published this year by Nation Books.

8. KIA: THE NEOLIBERAL INVASION OF INDIA


A March 2006 pact under which the United States agreed to supply nuclear fuel to India for the production of electric power also included a less-publicized corollary — the Knowledge Initiative on Agriculture. While it’s purportedly a deal to assist Indian farmers and liberalize trade (see story 4), critics say the initiative is destroying India’s local agrarian economy by encouraging the use of genetically modified seeds, which in turn is creating a new market for pesticides and driving up the overall cost of producing crops.

The deal provides a captive customer base for genetically modified seed maker Monsanto and a market for cheap goods to supply Wal-Mart, whose plans for 500 stores in the country could wipe out the livelihoods of 14 million small vendors.

Monsanto’s hybrid Bt cotton has already edged out local strains, and India is currently suffering an infestation of mealy bugs, which have proven immune to the pesticides the chemical companies have made available. Additionally, the sowing of crops has shifted from the traditional to the trade friendly. Farmers accustomed to cultivating mustard, a sacred local crop, are now producing soy, a plant foreign to India.

Though many farmers are seeing the folly of these deals, it’s often too late. Suicide has become a popular final act of opposition to what’s occurring in their country.

Vandana Shiva, who for 10 years has been studying the effects of bad trade deals on India, has published a report titled Seeds of Suicide, which recounts the deaths of more than 28,000 farmers who killed themselves in despair over the debts brought on them by binding agreements ultimately favoring corporations.

Hope comes in the form of a growing cadre of farmers hip to the flawed deals. They’ve organized into local sanghams, 72 of which now exist as small community networks that save and share seeds, skills, and assistance during the good times of harvest and the hard times of crop failure.

9. THE PRIVATIZATION OF AMERICA’S INFRASTRUCTURE


In 1956, President Dwight D. Eisenhower ushered through legislation for the greatest public works project in human history — the interstate highway system, 41,000 miles of roads funded almost entirely by the federal government.

Fifty years later many of those roads are in need of repair or replacement, but the federal government has not exactly risen to the challenge. Instead, more than 20 states have set up financial deals leasing the roads to private companies in exchange for repairs. These public-private partnerships are being lauded by politicians as the only credible financial solution to providing the public with improved services.

But opponents of all political stripes are criticizing the deals as theft of public property. They point out that the bulk of benefits is actually going to the private side of the equation — in many cases, to foreign companies with considerable experience building private roads in developing countries. In the United States these companies are entering into long-term leases of infrastructure like roads and bridges, for a low amount. They work out tax breaks to finance the repairs, raise tolls to cover the costs, and start realizing profits for their shareholders in as little as 10 years.

As Daniel Schulman and James Ridgeway reported in Mother Jones, "the Federal Highway Administration estimates that it will cost $50 billion a year above current levels of federal, state, and local highway funding to rehab existing bridges and roads over the next 16 years. Where to get that money, without raising taxes? Privatization promises a quick fix — and a way to outsource difficult decisions, like raising tolls, to entities that don’t have to worry about getting reelected."

The Indiana Toll Road, the Chicago Skyway, Virginia’s Pocahontas Parkway, and many other stretches of the nation’s public pavement have succumbed to these private deals.

Cheerleaders for privatization are deeply embedded in the Bush administration (see story 7), where they’ve been secretly fostering plans for a North American Free Trade Agreement superhighway, a 10-lane route set to run through the heart of the country and connect the Mexican and Canadian borders. It’s specifically designed to plug into the Mexican port of Lázaro Cárdenas, taking advantage of cheap labor by avoiding the International Longshore and Warehouse Union, whose members are traditionally tasked with unloading cargo, and the International Brotherhood of Teamsters, whose members transport that cargo that around the country.

10. VULTURE FUNDS: DEVOURING THE DESPERATE


Named for a bird that picks offal from a carcass, this financial scheme couldn’t be more aptly described. Well-endowed companies swoop in and purchase the debt owed by a third world country, then turn around and sue the country for the full amount — plus interest. In most courts, they win. Recently, Donegal International spent $3 million for $40 million worth of debt Zambia owed Romania, then sued for $55 million. In February an English court ruled that Zambia had to pay $15 million.

Often these countries are on the brink of having their debt relieved by the lenders in exchange for putting the owed money toward necessary goods and services for their citizens. But the vultures effectively initiate another round of deprivation for the impoverished countries by demanding full payment, and a loophole makes it legal.

Investigative reporter Greg Palast broke the story for the BBC’s Newsnight, saying that "the vultures have already sucked up about $1 billion in aid meant for the poorest nations, according to the World Bank in Washington."

With the exception of the BBC and Democracy Now!, no major news source has touched the story, though it’s incensed several members of Britain’s Parliament as well as the new prime minister, Gordon Brown. US Reps. John Conyers (D-Mich.) and Donald Payne (D-N.J.) lobbied Bush to take action as well, but political will may be elsewhere. Debt Advisory International, an investment consulting firm that’s been involved in several vulture funds that have generated millions in profits, is run by Paul Singer — the largest fundraiser for the Republican Party in the state of New York. He’s donated $1.7 million to Bush’s campaigns.

Who killed Brad Will?

Oaxaca, Mexico — Those of us who report from the front lines of the social-justice movement in Latin America share an understanding that there’s always a bullet out there with our name on it. Brad Will traveled 2,500 miles, from New York to this violence-torn Mexican town, to find his.

Throughout the summer and fall of 2006, the southern Mexican state of Oaxaca was on fire. Death squads, the pistoleros of a despised governor, rolled through the cobblestoned streets of this colonial capital, peppering with automatic weapon fire the flimsy barricades erected by masked rebels. Hundreds were killed, wounded, or imprisoned.

Will, a New York Indymedia videojournalist, felt he had to be there. Xenophobia was palpable on the ground when Will touched down. Foreign journalists were attacked as terrorists by the governor’s sycophants in the media: "Si ves un gringo con cámara, matanlo!" the radio chattered — if you see a gringo with a camera, kill him!

For much of the afternoon of Oct. 27, Will had been filming armed confrontations on the barricades just outside the city. He was trapped in the middle of a narrow street while gunshots boomed all around him, but he kept filming, looking for the money shot.


And he found it: on his final bits of tape, two clearly identifiable killers are perfectly framed, their guns firing. You hear the fatal shot and experience Brad’s shudder of dismay as the camera finally tumbles from his hands and bounces along the sidewalk.

By all visible evidence, Brad Will filmed his own murder. But this is Mexico, where justice is spelled impunity — and Will’s apparent killers continue to ride the streets of Oaxaca, free and, it seems, untouchable.

Curiously, this egregious murder of a US reporter in Mexico has drawn minimal response from US Ambassador Tony Garza, an old crony of President George W. Bush. Why this lack of interest? Can it be that Washington has another agenda that conflicts with justice for Will — the impending privatization of Mexican oil?

HEADING SOUTH


Will was once a fire-breathing urban legend on Manhattan’s Lower East Side. Whether perched atop the Fifth Street squat where he had lived for years and waving his long arms like Big Bird as the wrecking ball swung in, or being dragged out of City Hall dressed as a sunflower while trying to rescue the neighborhood’s community gardens, this child of privilege from Chicago’s wealthy North Shore was a legitimate street hero in the years before the World Trade Center towers collapsed and the social-change movement in New York City went into deep freeze.

Will hosted an incendiary weekly show on the New York pirate station Steal This Radio and was an early part of Indymedia, the Web publishing experiment born during the "Battle of Seattle," the World Trade Organization protests that rocked that city in 1999.

With his long hair neatly tied back and parted down the middle, with his granny glasses and fringe beard, and with his fierce commitment to building community, Will seemed to have emerged whole from a more utopian time in America.

He was an independent journalist, one of the growing number of people, such as Josh Wolf in San Francisco, who use the Internet and their video cameras to track and report on social moments and injustice. He wore no credential from any major news organization. But using outlets like Indymedia, he — like Wolf, who spent seven months in prison to avoid giving the police a copy of his video outtakes — represented part of the future of journalism.

Will’s journey to the land where he would die began right after Sept. 11, 2001. Dyan Neary, then a neophyte journalist, met Will in a South Street skyscraper elevator coming down from the WBAI studios from which Amy Goodman broadcast soon after the terrorist attacks.

"We walked down the piles. They were still smoking," Neary remembered in a phone call from Humboldt County. "We were both really scared. We thought this was not going to be resolved soon. Maybe never. So we thought we should go to Latin America, where people were still fighting."

Will and Neary spent most of 2002 and 2003 roaming the bubbling social landscape of Latin America. In Fortaleza, Brazil, they confronted the director of the Inter-American Development Bank during riotous street protests. They journeyed to Bolivia too and interviewed Evo Morales, not yet the president. They traveled in the Chapare rainforest province with members of the coca growers’ federation. They hung out in Cochabamba with Oscar Olivera, the hero of the battle to keep Bechtel Corp. from taking over that city’s water system. Everywhere they went, they sought out pirate radio projects and offered their support.

In February 2005, Will was in Brazil, in the thick of social upheaval, filming the resistance of 12,000 squatters at a camp near the city of Goiânia in Pernambuco state, when the military police swept in, killing two and jailing hundreds. On his videos, you can hear the shots zinging all around him as he captured the carnage. Will was savagely beaten and held by the police. Only his US passport saved him.

Undaunted by his close call, Will picked up his camera and soldiered back through Peru and Bolivia, and when the money ran out, he flew back to New York to figure out how to raise enough for the next trip south. He was hooked. In early 2006, drawn like a moth to flame, he was back, tracking Subcomandante Marcos and the Zapatistas’ Other Campaign through the Mayan villages on Mexico’s Yucatán Peninsula.

In the spring of 2006, Will was back in New York as he tracked the Other Campaign and the incipient rebellion in Oaxaca on the Internet from his room in Williamsburg. (The rent gougers had forced him out of the Lower East Side.) He was poised to jump south again, friends say, but was worried that he would just be one more white guy getting in the way.

In the end, the lure of the action in Oaxaca pulled him in. He bought a 30-day ticket, caught the airport shuttle from Brooklyn to John F. Kennedy International Airport, and flew south Sept. 29. His return was set for Oct. 28. He never made that flight.

THE COMMUNE OF OAXACA


A mountainous southern Mexican state traversed by seven serious sierras, Oaxaca is at the top of most of the nation’s poverty indicators — infant mortality, malnutrition, unemployment, and illiteracy. Human rights violations are rife. It’s also Mexico’s most indigenous state, with 17 distinct Indian cultures, each with a rich tradition of resistance to the dominant white and mestizo overclass. Oaxaca vibrates with class and race tensions that cyclically erupt into uprising and repression.

The Party of the Institutional Revolution, or PRI, ruled Mexico from 1928 to 2000, the longest-running political dynasty in the world. The corrupt organization was dethroned by the right-wing National Action Party (PAN) and its picaresque presidential candidate, Vicente Fox, former president of Coca Cola México.

But in Oaxaca, the PRI never lost power. While voters were throwing off the PRI yoke all over the rest of the country, in Oaxaca one PRI governor had followed another for 75 years. The latest, Ulises Ruiz Ortiz, a protégé of party strongman and future presidential candidate Roberto Madrazo, won a fraud-marred election over a right-left coalition in 2004.

In the first 16 months of his regime, Ruiz proved spectacularly unresponsive to the demands of the popular movements for social justice. When, on May 15, 2006, National Teachers Day, a maverick, militant local of the National Education Workers Union known as Section 22 presented its contract demands, Ruiz turned a deaf ear. Then, on May 22, tens of thousands of teachers took the plaza and 52 surrounding blocks and set up a ragtag tent city. Each morning the maestros would march out of their camp and block highways and government buildings, which were soon smeared with anti-Ruiz slogans.

Ruiz retaliated before dawn June 14, sending 1,000 heavily armed police officers into the plaza to evict the teachers. Low-flying helicopters sprayed pepper gas on the throng below. Ruiz’s police took up positions in the colonial hotels that surround the plaza and tossed down concussion grenades from the balconies. Radio Plantón, the maestros’ pirate radio station, was demolished and the tent city set afire. A pall of black smoke hung over the city.

Four hours later a spontaneous outburst by Oaxaca’s very active community, combined with the force of the striking teachers and armed with clubs and Molotov cocktails, overran the plaza and sent Ruiz’s cops packing. No uniformed officers would be seen on the streets of Oaxaca for many months. And on June 16, two days after the monumental battle, 200,000 Oaxacans marched through the city to repudiate the governor’s "hard hand." The megamarch was said to extend 10 kilometers.

John Gibler, who closely covered the Oaxaca uprising as a human-rights fellow for Global Exchange, wrote that the surge of the rebels June 14 soon transformed itself into a popular assembly. The Oaxaca Peoples Popular Assembly, or APPO, was formally constituted June 21. The APPO had no leaders but many spokespeople, and all decisions had to be made in assemblies.

A CITY PARALYZED


For the next weeks, the actions of the APPO and Section 22 paralyzed Oaxaca — but the rest of Mexico took little notice. Instead, the nation was hypnotized by the fraud-marred July 2 presidential election in which a right-wing PAN-ista, Felipe Calderón, had been awarded a narrow victory over leftist Andrés Manuel López Obrador, the candidate of a coalition headed by the Party of the Democratic Revolution. López Obrador was quick to cry fraud, pulling millions into the streets in the most massive political demonstrations in Mexican history. Oaxaca still seemed like small potatoes.

But Oaxaca is an international tourist destination, and the APPO and Section 22 protests had closed down the tourist infrastructure, blocking the airport and forcing five-star hotels to shutter their doors. On July 17, Ruiz was forced to announce the cancellation of the Guelaguetza, an indigenous dance festival that has become Oaxaca’s premiere tourist attraction, after roaming bands of rebels destroyed the scenery and blockaded access to the city.

Ruiz began to fight back. By the first weeks of August, the governor launched what came to be known as the Caravan of Death — a train of 30 or 40 private and government vehicles rolling nightly, firing on the protesters. Ruiz’s gunmen were drawn from the ranks of the city police and the state ministerial police.

To keep the Caravan of Death from moving freely through Oaxaca, the APPO and the union threw up barricades; 1,000 were built in the working-class colonies throughout the city and its suburbs. The rebels piled up dead trees, old tires, and burned-out cars and buses to create the barricades, which soon took on a life of their own; murals were painted using the ashes of the bonfires that burned all night on the barriers. Indeed, the barricades gave the Oaxaca struggle the romantic aura of the Paris Commune uprising of 1871 and attracted droves of dreadlocked anarchists to the city.

An uneasy lull in the action gripped Oaxaca on Oct. 1, when Will arrived at the bus terminal, then found himself a cheap room for the night. The break wouldn’t last long.

ON THE BARRICADES


Like most non-Mexicans who style themselves as independent reporters, Will had no Mexican media credential and therefore was in the country illegally, working on a tourist visa and susceptible to deportation. To have some credential other than his Indymedia press card to hang around his neck, he got himself accredited with Section 22 and wore the rebel ID assiduously.

On Oct. 14, APPO militant Alejandro García Hernández was cut down at a barricade near Símbolos Patrios, a downtown plaza. Will joined an angry procession to the Red Cross hospital where the dead man had been taken.

In the last dispatch he filed from Oaxaca, on Oct. 16, Will caught this very Mexican whiff of death: "Now [García Hernández lies] waiting for November when he can sit with his loved ones on the day of the dead and share food and drink and a song … one more death — one more martyr in a dirty war — one more time to cry and hurt — one more time to know power and its ugly head — one more bullet cracks the night."

The dynamic in Oaxaca had gotten "sketchy," Will wrote to Neary. Section 22 leader Enrique Rueda Pacheco had cut a deal with the outgoing Fox government and forced a back-to-work vote Oct. 21 that narrowly carried amid charges of sellout and payoffs. If the teachers went back to work, the APPO would be alone on the barricades and even more vulnerable to Ruiz’s gunmen. But backing down was not in the assembly’s dictionary, and the APPO voted to ratchet up the lucha (struggle) and make Oaxaca really ungovernable.

Mobile brigades were formed — young toughs armed with lead pipes and nail-studded boards who hijacked buses still running in the city, forced the passengers off, and rode around looking for action. Later the buses would be set afire. Charred hulks blossomed on the streets of the old colonial city. The barricades were reinforced to shut down the capital beginning Oct. 27.

The escalation proved to be a terrible miscalculation. In Mexico City the postelectoral turmoil had finally subsided, and PAN was ready to deal with the PRI; bailing out the governor of Oaxaca was the PRI’s price of admission.

It wasn’t a good time for inexperienced foreigners. Ruiz’s people were checking the guest lists at the hostels for "inconvenient" internationals. Immigration authorities threatened extranjeros with deportation if they joined the protests. The local US consul, Mark Leyes, warned Americans that he would not be able to help them if they got caught up in the maelstrom.

Adding to this malevolent ambiance, a new pirate station popped up Oct. 26. Radio Ciudadana (Citizens’ radio) announced it was broadcasting "to bring peace to Oaxaca" and to celebrate the honor of "our macho, very macho governor." The announcers seemed to have Mexico City accents. Wherever they had been sent from, they let loose with a torrent of vitriolic shit — stuff like "We have to kill the mugrosos [dirty ones] on the barricades." The extranjeros, the radio said, were stirring up all the trouble: "They pretend to be journalists, but they have come to teach terrorism classes."

More frightening was this admonition: "Si ves un gringo con cámara, matanlo!" — "If you see a gringo with a camera, kill him!"

This poison spewed out of local radios all day Oct. 26 and 27, but whether Will heard the warnings — and if he did, whether knew what they meant — is unclear. He didn’t speak much Spanish.

SHOT IN THE CHEST


On Oct. 27, Will went out to do interviews on the barricade at Santa María Coyotepec, about 20 kilometers from the city. The three barricades at Coyotepec, Cal y Canto, and La Experimental were crucial to closing down Oaxaca the next day. The broad Railroad Avenue where the barricade was stacked was empty. Nothing was moving. Will walked on to the next barricade at La Experimental to check out the action.

Soon after the Indymedia reporter left, all hell broke loose at Cal y Canto. A mob of about 150 Ruiz supporters stormed down Railroad Avenue, led by what witnesses thought was a Chevy Blazer. The vehicle was moving very fast. "We thought it would try and crash through the barricade," Miguel Cruz, an activist and witness, recalled. But the SUV stopped short, and several men jumped out with guns blazing. The APPO people hunkered down behind the makeshift barrier and moved the women and kids who were with them into a nearby house. Then they went on the counterattack with Molotov cocktails, homemade bazookas that fired bottle rockets, and slingshots. Most of the mob had melted away, and with the gunmen retreating, the rebels torched their vehicle.

Will heard about the gunfire and hurried back to Cal y Canto with a handful of other reporters. They arrived a little after 3 p.m.

Will climbed under a parked trailer to film the shooters. He focused on a man in a white shirt. When an APPO activist (who is not seen on the videotape) came running by, Will indicated the shooter — "Camisa blanca." While all this was going on, the camera captured a bicyclist peddling dreamily through the intersection. Soon after, a large dump truck appeared on the scene, and the group on the barricade used it as a mobile shield as they chased the gunmen down the avenue.

Suddenly, the pistoleros veered down a narrow side street, Benito Juárez, and took refuge in a windowless, one-story building on the second block. The only access to the building was through a large metal garage door, and the reporters followed the APPO militants, many of whom were masked, as they tried to force their way in. Will stood to one side of the door for a minute, poised for the money shot. Then the compas tried unsuccessfully to bust down the big door by ramming the dump truck into it.

In the midst of this frenzy, five men in civilian dress — two in red shirts (the governor’s color) and the others in white — appeared at the head of Benito Juárez, about 30 meters away, and began shooting at the rebels.

Two of the gunmen were later identified by Mexican news media as Pedro Carmona, a cop and local PRI political fixer, and police commander Orlando Manuel Aguilar Coello. One of those in the white shirts, crouched behind Carmona, was Abel Santiago Zárate, a.k.a. El Chino. Santiago Zárate and Aguilar Coello were reported to be the personal bodyguards of municipal president Manuel Martínez Feria of the PRI. The other two would later be fingered as Juan Carlos Soriano, a.k.a. El Chapulín (the grasshopper), and Juan Sumano, both Santa Lucía del Camino police officers. All five are eminently identifiable in the film Will shot just moments before the bullets hit him.

When the shooting erupted, Will took cover on the opposite side of the narrow street from the rest of the media. He was crouched against a lime green wall when the first bullet came. On the video soundtrack, you can hear both the shot and Will’s cries of dismay as it tore through his Indymedia T-shirt and smashed into his heart. A second shot caught him in the right side and destroyed his innards. There was little blood spilled, the first slug having stopped his heart.

In footage that witness Gustavo Vilchis and others filmed, the entrance wound of the first shot looks like a deep bruise. The second shot was not recorded on the soundtrack and may have been fired simultaneously with the first.

Others were shot in the pandemonium. Oswaldo Ramírez, filming for the daily Milenio, was grazed. Lucio David Cruz, described as a bystander, was hit in the neck and died four months later.

As Will slid down the wall into a sitting position, Vilchis and activist Leonardo Ortiz ran to him. Will’s Section 22 credential had flown off, and no one there knew his name. With bullets whizzing by, the compas picked Will up and dragged him out of the line of fire and around the corner to Árboles Street, about 35 paces away. Along the way, his pants fell off.

"Ambulance! We need an ambulance! They’ve shot a journalist!" Vilchis, a tall young man with a face like an Italian comic actor’s, shouted desperately. Gualberto Francisco, another activist, had parked his vochito (Volkswagen Bug) on Árboles and pulled up alongside Will, who was laid out on the pavement in his black bikini underwear.

Ortiz and Vilchis loaded the dying Will into the back seat. They thought he was still breathing, and Vilchis applied mouth-to-mouth resuscitation. "You’re going to make it … you’re all right," they kept telling him. But Will’s eyes had already turned up — he was perdido (lost), as they say in Mexico.

The vochito ran out of gas, and while the frantic young men ferrying Will were stuck in the middle of the Cinco Señores crossroad, it began to rain hard. They tried to stop a taxi to take them to the Red Cross, but the driver supported the government and wanted to argue. Finally, they flagged down a pickup truck and laid Will out in the bed. He was dead when he arrived at the hospital, according to the report by the coroner, Dr. Luis Mendoza.

THE OUTRAGE BEGINS


Oct. 27 was the bloodiest day of the Oaxaca uprising. Four people were killed besides Will: Emilio Alonso Fabián, Esteban Ruiz, Esteban López Zurita, and Audacia Olivera Díaz.

Unlike their murders, Will’s death triggered international outrage. Because he was so connected — and because much of the episode was recorded on film —the shot of the mortally wounded Indymedia reporter lying in the middle of a Oaxaca street went worldwide on the Web in a matter of minutes.

There were instant vigils on both coasts of the United States. On Oct. 30, 11 of Will’s friends were busted trying to lock down at the Mexican consulate off Manhattan’s Park Avenue, where graffiti still read "Avenge Brad!" in December. Anarchists splattered the San Francisco consulate with red paint. Subcomandante Marcos sent his condolences and called for international protests. Goodman did an hour-long memorial.

On March 16, 2007, at its midyear meeting in Cartagena de Indias, Colombia, the Inter-American Press Association, an organization devoted to freedom of speech and the press in the Americas, passed a resolution calling for action on the Will case.

"The investigation into the killing has been plagued by irregularities and inconsistencies, and no arrests have been made," the group said in a statement. IAPA called for the federal attorney general to take over the investigation, "in view of the lack of confidence in state authorities and the lack of progress in the case, so that it may apprehend the culprits, who, according to one theory of the investigation, may be indirectly linked to state authorities."

The official reaction to Will’s death was more cautious. "It is unfortunate when peaceful demonstrations get out of hand and result in violence," a US spokesperson told the media, seeming to blame the APPO for Will’s killing. After once again warning Americans that they traveled to Oaxaca "at their own risk," Ambassador Garza commented on the "senseless death of Brad Will" and how it "underscores the need for a return to the rule of law and order."

"For months," he said, "violence and disorder in Oaxaca have worsened. Teachers, students, and other groups have been involved in increasingly violent demonstrations."

Garza’s statement sent Fox the signal he had been waiting for. Now that a gringo had been killed, it was time to act. The next morning, Oct. 28, 4,500 officers from the Federal Preventative Police, an elite force drawn from the military, were sent into Oaxaca — not to return the state to a place where human rights, dignity, and a free media are respected but to break the back of the people’s rebellion and keep Ruiz in power.

On Oct. 29 the troops pushed their way into the plaza despite massive but passive resistance by activists, tore down the barricades, and drove the commune of Oaxaca back into the shadows.

In Mexico the dead are buried quickly. After the obligatory autopsy, Brad’s body was crated up for shipment to his parents, who now live south of Milwaukee. After a private viewing, the family had him cremated.

SHAM ACCOUNTABILITY


Killing a gringo reporter in plain view of the cameras (one of which was his own) requires a little sham accountability. On Oct. 29 the state prosecutor, Lizbeth Caña Cadeza, announced that arrest warrants were being sworn out for Santiago Zárate and Aguilar Coello, two of the five cops caught on film gunning Will down, and they were subsequently taken into custody.

The scam lost currency two weeks later when, on Nov. 15, Caña Cadeza dropped a bombshell at an evening news conference: the cops hadn’t killed Will, she said; he was shot by the rebels.

Will’s death, she insisted, had been "a deceitful confabulation to internationalize the conflict" and was, in fact, "the product of a concerted premeditated action." The mortal shot had been fired from less than two and a half meters away, Caña Cadeza said — although there is nothing in the coroner’s report to indicate this. The real killers, she said, were "the same group [Will] was accompanying."

In the state prosecutor’s scenario, the order of the shots was reversed: first Will had been shot in the side on the street, then rematado (finished off) with a slug to the heart on the way to the hospital in Francisco’s vochito.

The prosecutor’s plot was immediately challenged by the APPO. "The killers are those who are shown in the film," Florentino López, the assembly’s main spokesperson, asserted at a meeting that night.

And in fact our detailed investigation shows that there is very little evidence to support Caña Cadeza’s theory. Photos from the scene, some published in the Mexican media, show Will’s body with a bloody hole in his chest on the street near where he fell — indicating that his fatal heart wound occurred well before he was dragged into the car where he was supposedly shot.

There’s another problem with the prosecutor’s suggestion: nobody on the scene saw any APPO members, or anyone except the authorities, carrying guns. This reporter has talked to numerous eyewitnesses, and all told the same tale: the rebels at the barricade that day had no firearms with which they could have shot Will.

Miguel Cruz, who spent much of Oct. 27 with Will, first at the Council of Indigenous People of Oaxaca, of which he is a member, and then on the barricade at Cal y Canto and on Juárez Street, is a soft-spoken young Zapotec Indian, but he pounded vehemently on the kitchen table when he addressed Caña Cadeza’s allegations.

"The compañeros had no guns. What gun is she talking about? They had slingshots and Molotovs but no guns. The PRI-istas and the cops had their .38s, and they were shooting at us," he said. "We were trying to save Brad Will’s life, not to kill him."

And if Caña Cadeza had any proof of her allegations, she likely would have filed charges. But none of the protesters or Will’s companions has been formally charged with the killing. Prosecutors have never publicly presented the alleged murder weapon.

But by the time Caña Cadeza told her story, of course, the only way to determine for sure the order of the bullets and the distance from which they had been fired would have been to exhume Will’s body. And there was no body; he had been cremated the week before.

On Nov. 28, Santiago Zárate and Aguilar Coello were released from custody by Judge Victoriano Barroso because of "insufficient evidence," with the stipulation that they could not be rearrested without the presentation of new evidence.

Caña Cadeza, who is now running as a PRI candidate for the state legislature, collaborated closely on the case with Oaxaca secretary of citizen protection Lino Celaya. Both reported to Ruiz’s secretary of government, Heliodoro Díaz, who in turn reported directly to the governor. There seems little doubt that the prosecutor’s accusations of murder against Will’s comrades — and the determination of innocence for the apparent killers — came straight from the top.

ON THE EVIDENCE TRAIL


Dr. Mendoza was occupied when I stopped by the Oaxaca city morgue to ask for a copy of the autopsy report on which the state has based its allegations.

"Will died eight months ago," Mendoza complained testily. "Do you know how many others have died since? How many autopsies I’ve performed?" He gestured to a morgue room where cadavers were piled up.

The coroner was scrunched over his desk, filling out the paperwork for one of the dead. He didn’t have any time to look for the autopsy report. I was not the first reporter to ask him about the document. "What paper are you from anyway?" he asked suspiciously, and when I showed him my media card, he told me that it didn’t sound like a real newspaper to him. "I know what I’m doing. I worked as a coroner in your country," he snapped defensively and waved me out of the office.

But Mendoza might not be quite as cocksure as he sounded. A senior agent for the US government in Oaxaca, who asked not to be named in this article, told me later that Mendoza confided to him that he was no ballistics expert, nor could he determine from how far away the bullets were fired.

I walked into the police commissary under the first-floor stairs of the Santa Lucía del Camino Municipal Palace. The small room was crowded with cops and cigarette smoke. Three of the officers were in full battle gear, and the rest were plainclothes. I had been warned not to ask for Carmona, the most prominent red shirt on Will’s film. Carmona is described as a prepotente — i.e., a thug with an attitude who is always packing.

Instead, I asked the desk clerk if I could get a few minutes with Santiago Zárate and Aguilar Coello. For all I knew, the two were sitting in the room behind me. The desk clerk studied my card. "Qué lástima!" he exclaimed — what a shame. Santiago Zárate had just left and wouldn’t be back until after six. Aguilar Coello was off that day. When I called back after six, Santiago Zárate was still not available. Nor were he and Aguilar Coello ever available the dozen or so times I called back.

This sort of stonewalling is not terribly unusual for Mexico, where killer cops often sell their services to local caciques (political bosses) and go back to work as if nothing had happened. Those who direct this sort of mayhem from their desks in the statehouses and municipal palaces — the "intellectual assassins," as they are called — are never held accountable for their crimes.

A VISIT FROM HOME


In March, Brad’s parents, Kathy and Howard Will, and his older brother and sister paid a sad, inconclusive visit to Oaxaca. They had hired Miguel Ángel de los Santos Cruz, a crackerjack human rights lawyer who has often defended Zapatista communities in Chiapas. Gibler, the Global Exchange human-rights fellow, was the translator.

The Wills, upper-middle-class Americans, had little experience with the kind of evil that lurks inside the Mexican justice system; the trip was a traumatic, eye-opening experience.

The federal Attorney General’s Office had taken over the case from the state in December, but rather than investigating police complicity and culpability, it was pursuing Caña Cadeza’s dubious allegation blaming Will’s companions for his killing.

Gustavo Vilchis, Gualberto Francisco, Leonardo Ortiz, and Miguel Cruz were summoned to give testimony, with the Wills in attendance. Testifying was a risky venture, as the witnesses could have been charged with the murder at any moment, but out of respect for the family, the compas agreed to tell their story to the federal investigators. During the hearing they were repeatedly questioned about and asked to identify not the cops who appear on Will’s film but their own compañeros, some masked, who appeared on tape shot by Televisa, the Mexican TV giant. They refused.

When Los Santos accompanied the Wills to a meeting with Caña Cadeza, she touted her investigation and promised them a copy of its results. But she refused to allow the family to view Will’s Indymedia T-shirt and the two bullets taken from his body. They were, she explained, under the control of Barroso — the judge who had cut loose the cops.

THE POLITICS OF OIL


There are larger geopolitics at work here.

The US Department of State has a certain conflict of interest in trying to push first-year Mexican president Calderón to collar Will’s killers. The crackdown in Oaxaca was all about a political deal between Calderón’s PAN and Ruiz’s PRI: if PAN saved the governor’s ass, the PRI would support the president’s legislative package.

Indeed, the PRI’s 100 votes in the lower house of the Mexican Congress guarantee Calderón the two-thirds majority he needs to alter the constitution and effect the change that’s at the top of his legislative agenda — opening up Petróleos Mexicanos, or PEMEX, the nationalized petroleum corporation and a symbol of Mexico’s national revolution, to private investment, a gambit that requires a constitutional amendment.

Since then-president Lázaro Cárdenas expropriated Mexico’s petroleum industry from Anglo and American owners and nationalized it in 1938, the United States has been trying to take it back. "Transnational pressure to reprivatize PEMEX has been brutal," observed John Saxe Fernandez, a professor of strategic resource studies at Mexico’s autonomous university, Universidad Nacional Autónoma de México.

During the run-up to the hotly contested 2006 presidential elections, candidates Calderón and López Obrador debated the privatization of Mexico’s national oil corporation before the American Chamber of Commerce in Mexico City; former US ambassador Jeffrey Davidow moderated the debate. When the leftist López Obrador insisted that he would never privatize what belonged to all Mexicans, the business leaders stared in stony silence. The conservative Calderón’s pledge to open PEMEX to private investment drew wild applause. Calderón was, of course, Washington’s horse in the fraud-marred election.

In order to accommodate Washington, Calderón needs a two-thirds majority in the congress — and the PRI’s votes in the lower house are crucial to guaranteeing passage of a constitutional amendment. "Without the PRI’s votes, PEMEX will not be privatized. That is why Calderón has granted Ruiz impunity," Saxe Fernandez concluded.

Washington is eager to see PEMEX privatized, which would create an opportunity for Exxon Mobil Corp. and Halliburton (now PEMEX’s largest subcontractor) to walk off with a big chunk of the world’s eighth-largest oil company. Pushing Calderón too hard to do justice for Will could disaffect the PRI and put a kibosh on the deal.

It is not easy to imagine Brad Will as a pawn in anyone’s power game, but as the months tick by and his killing and killers sink into the morass of memory, that is exactly what he is becoming. 2
