Flowers unempowered

It’s been quite a year for local florist Guy Clark. His dad passed away about a year ago, and Clark suffered a heart attack shortly afterward. Two weeks later, the building at 15th and Noe where he rents garage space to sell flowers caught on fire. The good news was that his space was not damaged. The bad news was that his landlord, Triterra Realty, didn’t immediately renovate the destroyed apartments and let most of the tenants move out, telling the two who remained, Clark and Irene Newmark, that they would have to move soon, too: once the renovations were completed, the building would be put on the market and possibly sold as Tenancy-in-Common (TIC) apartments.

Some more bad news came the other day, on the morning of Jan. 22 when Clark discovered his space had been vandalized in an apparent hate crime.

“KKK” was scrawled across the garage door in blue paint. “Fuck you” with an arrow pointing to the door was written in off-white paint on the sidewalk. Additional garnishes of white and blue were splashed and smeared throughout the area.

“They totally trashed the place,” Clark told the Guardian. “I imagine that it’s geared toward me because I’m an African American.”

Clark said he notified the San Francisco Police Department, and an officer came by to file a report and take some pictures. The case will be referred to the Hate Crimes unit.

“I can’t really think of anybody who would do something like this,” said Clark, adding that he recently had a minor altercation with a neighbor up the street but no other suspects immediately came to mind. “Ninety-nine percent of the people who come by are a blessing.”

Clark has been living and selling flowers in the neighborhood for 25 years, and renting this particular space for five. The Guardian awarded his shop a Best of the Bay in 2005.

“This is more than tragic. Guy is very loved by this neighborhood,” said Irene Newmark, who lives in the building where Guy’s Flowers is housed. Newmark thinks increased gentrification, while not directly related to the hate crime, is changing the place where she’s lived for many years. Newmark listed off several nearby properties that have been sold recently or are on the market, including one that sits vacant across the street.

“They offered to buy me out for $10,000, but that’s not a financial incentive to move,” she said, adding that by the time she paid taxes on the money and found a new place to live most of the money would be gone. She said the owners of the building told her their intent was to sell the building on TIC speculation and “the day it sells you’ll receive your Ellis Act notice.”

Riyad Salma, a spokesperson from Triterra Realty, based on nearby Sanchez Street, said the company has joint ownership of a few other properties in the neighborhood and would be putting a different TIC on the market shortly. He didn’t want to comment on the TIC prospects for the building where Guy’s Flowers is housed, saying it was too market dependent and difficult to say at this point what they will do. He did confirm that the building would be put up for sale soon, “marketed as a whole building or TICs. Whoever will take it,” he said.

Salma also expressed dismay about the crime. “The vandalism seemed to be hate-motivated and race-motivated and it’s not something we’ve ever seen in the neighborhood,” he said.

Sitting on a bench among pots of flowers that decorate the sidewalk in front of her building, Newmark said, “It’s so ironic that those that are beautifying the neighborhood are being forced out.”

Nearby a Department of Public Works employee wielded a hose like a magic wand, trying to make the hateful slurs disappear.

Clark said he plans to keep doing what he does for as long as he can, whether it’s in this building or the one where he lives, four doors down the street.

“I’m usually closed on Mondays and Tuesdays,” said Clark. “But I was thinking about just going and selling whatever I had left. The idea of selling flowers makes me feel better.”

The Presidio Trust’s mystery millions

The Presidio Trust just published its annual report for 2006. This slick-looking document is distributed to the national park’s George W. Bush–appointed board of directors — and to the purported shareholders of this quasi corporation, the American taxpayers.

If you just read the executive director’s message, scan the pretty pictures, and glance at the numbers to make sure they’re on the proper side of zero, then this unique endeavor to privatize a national park looks peachy. Revenue is coming in, operating expenses are being covered, projects are getting completed. The goal is to be self-sufficient by 2013 without any federal subsidy; the trust thinks it will meet that goal. Donald Green, a former economist for the Office of Management and Budget and SRI International and now a Sierra Club Presidio committee member, told us he agrees.

"The financial picture, from their point of view and mine, is good," Green said. "They’re already financially viable."

But when the Guardian took a look at the balance sheets, we had a few troubling questions. The investments line in the assets category jumped out at us: it turns out the Presidio Trust has more than $105 million in the bank. Well, not quite in the bank — that money’s actually invested in federal securities. But it’s still a huge pile of cash for a public agency to sit on. The National Park Foundation, another goverment agency chartered by Congress, that collects funding from philanthropists and private corporations to support national parks, had total assets of $81 million for 2005, $58 million of which is invested in marketable securites.

What is all that money for, where did it come from, and why isn’t it being used? And if the trust has so much in the bank already, why did its leaders ask Congress for a $20 million loan for 2008 — on top of $50 million the federal government has already loaned the trust?

The answers — or rather, the lack of answers — demonstrate exactly what’s wrong with Presidio Trust operations.

According to a detail of the assets line item, the trust, which spends about $50 million a year running the park, has $103,031,000 in excess money invested in nonmarketable Treasury securities. About a third of that doesn’t mature until 2029. Another two-thirds — $69,787,000 — has the slightly lower interest rate of 5.02 percent and will drop $2 million of interest into the kitty for 2006, leaving a balance of $105 million.

At the same time the trust is investing in the Treasury, it’s also making interest payments. In 1999 the park borrowed $49,978,000 to jump-start renovations and get some money flowing. So far, the trust has only been paying off the interest on the loan, at 6.12 percent — which translates to a hair less than $3 million per year.

Pause now to consider those numbers: making $2 million in interest, spending $3 million on interest payments. Huh.

According to Dana Polk, the trust’s senior adviser for government and media relations, the $105 million is a combination of money granted by the Department of Defense for environmental remediation, unspent money from the 1999 loan, and money received from various sources and obligated toward various projects.

When we asked for more specifics on how much money came from where and how it’s going to be spent, Polk said there was an itemized detail of that budget line but added, "That’s not a public document."

In other words, the taxpayers don’t get to know what’s happening with their money.

"Often they don’t want to even explain their own numbers," Green said, "which is pretty pathetic for a governmental organization."

What we do know is that when the Army turned over the base to the trust, the Department of Defense cut a $99 million check to pay for the toxic spillage left in 15 areas throughout the park. About half that money has been spent, and places such as Coyote Gulch, Sunset Scrub, and Thompson Reach are now reblossoming into the natural areas they once were.

But in the seven years since these projects began, unknown contaminants and cost overruns for the massive environmental remediation projects have bumped the total price tag from $100 million to $130 million.

A note in the annual report states that $23 million of the overrun is still unfunded and is expected to come from interest earned on investments, "of which $14.9 million has already been earned."

Those of you who are not utterly boggled by these numbers may extrapolate from an above paragraph that the trust is netting about $2 million a year in interest income. It’s going to be a while before the agency has that $23 million to pay for the guys in the Hazmat suits.

Additionally, the report reads, "If cleanup costs for the enumerated sites exceed the $100 million threshold … by $10 million, the Army must seek additional appropriated funds for the enumerated sites."

Polk confirmed the trust is pursuing additional funding from the Department of Defense and from insurance that is carried for the projects.

So why does the trust still need to earn $23 million in interest if it is asking the DOD for the money anyway?

The trust isn’t a bank, so why does it need to sit on so much money rather than spend it on the various projects around the park, many of which are currently funded by tenants or philanthropists? Right now tenants who are leasing space have to pay for their own renovations.

What special projects is the money earmarked for?

There may be a perfectly sound explanation, but we’ve tried mightily to extract it from Presidio officials, and we are, frankly, baffled. Polk refused to answer our questions — and when we pressed her, she said our coverage of the park is too critical. Then she hung up on us.

But $105 million is a lot of money; maybe Polk can explain it to you.

It’s been quite a political year in San Francisco. And 2007 is going to be better.


I was talking to my friend and colleague Steve Jones just before Christmas about the folks in the Mayor’s Office (and elsewhere) who still think a progressive vision for San Francisco — a city where the rich pay their fair share, where the public sector provides a wealth of services to the public, where money doesn’t rule politics and elected officials are accountable, a place where tenants are protected and land use is determined by community needs and not developer demands, a city that serves as a model for the rest of the country — is just some sort of wild and pointless fantasy. And Steve and I agreed: in 2006 the progressives won a lot of the key battles, and the so-called moderates who have no vision at all were on the defensive most of the time.


We’ve had setbacks. Things aren’t perfect. But I’ve been living in this city and watching politics for a long time now, and I can honestly say that we’re making progress.


San Francisco has a program that’s aimed at providing health insurance to everyone. San Francisco has a living-wage law. San Francisco has laws that require sizable payments to tenants who are being evicted and that require employers to offer sick days. San Francisco is going to elect its next mayor under a public-financing system that might actually allow genuine candidates who lack downtown money to compete.


San Francisco is demanding that cops actually walk beats in high-crime areas and seriously talking about demanding that almost two-thirds of all new housing be available at below-market rates. San Francisco is moving to provide public power in Hunters Point and at Treasure Island.


And none of that came out of the Mayor’s Office.


The policy debates in this city are happening at the Board of Supervisors, where district-elected representatives are pushing progressive ideas that would never have gone beyond the wild-dream stage 10 years ago.


We’re not all the way there. We still fight with each other and let our egos get in the way. We’re still trying to figure out how to deal with the fact that state and federal laws limit how far we can go to raise money and protect the vulnerable. We still aren’t quite willing as a city or a progressive movement to commit to income and wealth redistribution (at home here, not in Washington or Sacramento), a cause that defines all that we think about and do — and we need to, or in the end nothing else matters.


We haven’t kicked out Pacific Gas and Electric Co. and created a full-on public power system yet. Black kids are still dying from gunfire in record numbers. We don’t have a candidate for mayor.


And all of the people who read this will think of other things we haven’t done, because we in the progressive movement love to complain and argue and we’re never satisfied — which is, in the end, a good thing.

And the big-money greedheads who have had their greasy paws on the levers of power in this town since the Gold Rush aren’t about to surrender. Every step forward is still a struggle.


But we kicked their asses in District Six — and that was one where both sides were in full-court press and everyone knew it mattered. They have come to realize we are not just crazy dreamers.

A key test for Pelosi

EDITORIAL Rep. Nancy Pelosi’s signature legislation came out of a Republican Congress. It was shortly after Newt Gingrich and his gang took control of the House that Pelosi began moving to privatize the Presidio; she argued that the GOP majority would never fund a real national park in San Francisco and the only way to prevent Congress from trying to sell off the land the military no longer wanted was to find a mechanism that wouldn’t cost any money and would be palatable to the archconservatives who were calling the shots.
When she’s criticized for the bill — and that’s been happening a lot lately — she replies, in effect: we had no choice. If we wanted to save this remarkable 1,400-acre parcel of land, we had to play the Republicans’ game. And indeed, her approach was everything that the Gingriches of the world liked: instead of using tax dollars to fund a national park (something that had been done since the birth of the National Park System), she created the semiprivate Presidio Trust, which was charged with raising enough cash through development and rents to pay the park’s own way by 2013.
Now we have George Lucas operating a commercial office building in the middle of the park and housing renting out at top market rates to wealthy tenants and a plan to turn a former hospital near Lake Street into a dense luxury condo complex — and, in general, the future of the park being driven by commercial interests.
But things are different now: Pelosi, not Gingrich, is calling the shots. The Democrats control both houses of Congress, the president is a lame duck bogged down in a war that is making him more unpopular by the day — and for the first time since the Sixth Army moved out and the privatizers moved in, there is no political reason why Pelosi can’t amend her bill and change the way the Presidio is run.
It’s clear that the current system isn’t working. The federal government keeps pouring big money into subsidizing the private ventures in the park. The Sierra Club, which initially supported Pelosi’s bill, is now demanding reform.
This is a test of how Pelosi will use her new power — and whether she was telling the truth when she blamed the privatization of the park on Republicans. She needs to introduce and push a bill to eliminate the Presidio Trust, turn the land over to the National Park Service, and manage it in the interest of the public, not private profit. SFBG

Newsom should comply with Prop. I

OPINION Much has been said about Mayor Gavin Newsom’s stunning defeat at the ballot Nov. 7. Newsom’s slate of endorsements went down in flames — from supervisorial candidates Rob Black and Doug Chan to the contenders he hoped would take control of the school board to a host of progressive ballot propositions, including worker sick leave and relocation assistance for evicted tenants. Every incumbent supervisor was also reelected, indicating an overall approval level of the Board of Supervisor’s performance. And the voters took a further unprecedented step with the passage of Proposition I, which asked the mayor to appear before the board in person once a month to discuss city policy. The voters sent a clear message that they want the mayor to work with the supervisors rather than against them.
Will Newsom respect the mandate and comply with Prop. I? It’s anyone’s guess right now. The measure is not legally binding, and he vehemently opposed it. Here are five reasons why Newsom should comply with Prop. I:
1. The voters asked him to. Newsom claims to care about the will of the voters. He cited the “will of the voters” as his basis for vetoing a six-month trial of car-free space in Golden Gate Park — even though a trial has never been voted on. Will he respect the voters this time?
2. The status quo is not working. The homicide rate, traffic deaths, and Muni service have gotten worse every year under the Newsom administration. Commissioners aren’t being appointed on time, police reform is off track, promised low-income housing is delayed, all bicycle improvements are on hold, and our roads are falling apart. Popular public events such as the North Beach Jazz Fest are under attack by a city government that can’t keep Halloween revelers safe. Meanwhile, the mayor focuses on political damage control related to his apparent loss of the 49ers in 2012 and the Olympics in 2016.
3. Newsom consistently opposes ideas coming from the Board of Supervisors but doesn’t seem to have any of his own. The homicide rate is at an all-time high and keeps getting worse. But Newsom has opposed every significant measure proposed by the supervisors, including funding for homicide prevention and assistance for victims’ families via Proposition A, as well as police foot patrols. Fare hikes and service cuts haven’t solved Muni’s problems, but Newsom sided with the local Republican Party in opposing Proposition E, which would have provided much-needed funding for Muni through an incremental increase in the car parking tax.
4. Newsom has been missing in action too long. The mayor spent almost the full first three years of his four-year term fundraising around the country to pay off his 2003 campaign debts. This busy fundraising schedule, combined with the demands of his relentless PR machine, has sent the mayor chasing photo ops in China; Italy; Washington, DC; Los Angeles; Chicago; New York; and a host of other places. The majority of the voters are now siding with progressives, the Guardian, and even the San Francisco Chronicle in asking “Where is the mayor?”
5. The voters asked him to. Really, that should be enough. No? SFBG

Campus crush

It’s easy to forget about the Villas Parkmerced.
Nestled in the foggiest, most sedate corner of San Francisco, the 62-year-old planned community feels like a slice of suburbia for seniors and families.
“There’s grass. There’s trees. There’s traffic circles where the cars can’t speed too damn much and knock off the pedestrians,” says 82-year-old Robert Pender, a tenant since 1967. “It’s forgettable suburbia in urban San Francisco.”
But the peace has been shattered recently by word that San Francisco State University is laying plans to transform its campus into a smaller version of UC Berkeley — with little apparent concern for its neighbors just across the street.
The SFSU administration has been busy at work for the past year on a new campus master plan. University officials say the body of college-bound students in California is steadily increasing and a campus overhaul is needed to accommodate that growth by 2020.
The proposed expansion calls for a conversion of many of the two-story buildings on campus to four- or five-story structures, as well as the construction of new buildings for academic, housing, and cultural purposes. A new 250-room hotel at 19th Avenue and Buckingham, a new creative arts facility, and a new gym are also on the table.
The project’s chief architect, James Stickley, told the Guardian that the master plan is about making SFSU “efficient as an urban campus” and transforming its character from a commuter campus to a destination community. In 15 years, he said, university officials expect to have 25,000 full-time students at the university (an increase of 5,000 students), many of them living on campus and taking advantage of new amenities and commercial ventures within university borders.
It’s an ambitious vision that aims to attract more students and accomplished professors to the SFSU campus. Which is great news for just about everyone — except the tenants of the 3,400-unit Villas Parkmerced, who allege not only that they were forgotten during the university planning process but also that their neighborhood is now coming under attack.
“I would love to see SFSU come out as a premier university and to have a really strong image,” said Adriana Torres, a current Parkmerced tenant and former SFSU student. She was speaking at a meeting held Oct. 24 to assess the environmental impacts of the university’s proposed master plan. “But you are not taking into consideration us, the people who live next to the students,” Torres continued. “I think what this plan is doing is, in building your image, it’s eroding ours.”
The meeting was hosted by campus planner Richard Macias and was attended by more than 70 disgruntled Parkmerced residents.
One major area of contention is the university’s proposal for Holloway Avenue, which separates much of the Parkmerced community from SFSU. The university intends to transform Holloway into what Stickley called “a campus street,” with around-the-clock commercial stores at street level and student housing above, something akin to Berkeley’s Telegraph Avenue. The university already owns much of the residential property on the south side of Holloway.
But Parkmerced tenants still occupy about 70 percent of that housing, and in their minds, plans for the gradual conversion of that property “for University uses as current occupants vacate their units,” as a university notice put it, sounds a lot like a friendly eviction letter.
“I have lived in Parkmerced all my life,” Healeani Ting said at the Oct. 24 meeting. “My grandmother died here. My mother died here. I intend to die here. Would you have me living in a relocation camp for the homeless in Fresno?”
Parkmerced tenants also assert that SFSU has drastically underestimated the impact of 5,000 additional students on the neighborhood.
Parking — no surprise — is the biggest issue. The university notes in a preliminary environmental review document that “the bulk of the University’s parking needs is met through the multistory parking garage east of Maloney Field” and therefore it won’t be adding any additional parking spots to accommodate 5,000 more students. Parkmerced tenants maintain their parking situation is already a nightmare, thanks to students snatching up spots in their community.
“If you think that you’re going to confine the garbage, the noise, the disruption to all the residents by keeping everyone along Holloway, you’re wrong,” Michelle Miller, a resident of Parkmerced and the head of a local organization called Neighborhood Watch, said at the Oct. 24 meeting. “They filter out. They all want cars. If you keep your parking flat, that’s not going to work.”
University spokesperson Ellen Griffin told the Guardian that SFSU is interested in fostering a “collegial relationship” with Parkmerced tenants and the university will be taking their complaints seriously. University officials met with Parkmerced tenants Nov. 9 to discuss some of their objections. According to Parkmerced Residents’ Organization board member Arne Larson, the university said it would consider moving graduate students and professors to Holloway instead of pursuing the campus street idea.
Of course, SFSU doesn’t have to do any of that. As a state entity, the university has the authority to create and adopt its own plans without involving the San Francisco Planning Department.
The university is preparing an environmental impact report — but no matter what the document says, the project can move forward without city review or approval.
Sarah Dennis, a senior planner with the Planning Department, told us her agency is concerned with the project on two counts: first, the campus street proposal threatens to drain 945 units from the city’s already vulnerable rental housing stock; and second, the overarching plan endangers the basic historic and cultural resources of the city. The Villas Parkmerced is one of only four urban master plan communities in the country.
“We’re hoping that they’ll follow the good-neighbor policy and that we’ll have the opportunity to get involved,” Dennis said. “But again, that’s all up to them.”
District 7 supervisor Sean Elsbernd said that he too is concerned with the SFSU master plan.
“At this point [the university is] at least recognizing this is going to have a massive impact,” Elsbernd told the Guardian, referring to the SFSU environmental impact report that is under way. “But we can guess what’s going to be in that EIR when it’s finally published: ‘Oh look, they say there won’t be much of an impact.’ That’s when the real fight happens.” SFBG

East Bay races and measures

Incumbent Roland Smith has to go. He’s been accused of harassing and verbally abusing his staff and using audits as a political weapon against his enemies. The county supervisors have had to reassign his staff to keep him from making further trouble. And yet somehow he survived the primary with 32 percent of the vote, putting him in a November runoff against Courtney Ruby, who led the field with 37 percent. Ruby, an experienced financial analyst, would bring some credibility back to the office.
Peralta Community College Board, District 7
ABEL GUILLEN
Challenger Abel Guillen has extensive knowledge of public school financing and a proven commitment to consensus building and government accountability. In the last six years Guillen, who was raised in a working-class community and was the first in his family to go to college, has raised $2.2 billion in bond money to construct and repair facilities in school districts and at community colleges. Incumbent Alona Clifton has been accused of not being responsive to teachers’ concerns about the board’s spending priorities and openness.
Berkeley mayor
TOM BATES
This race has progressives tearing at each other’s throats, particularly since they spent a ton of cash last time around to oust former mayor Shirley Dean and replace her with Tom Bates, who used to be known as a reliable progressive voice.
Bates’s reputation has shifted since he became mayor, and his record is a mixed bag. This time around, he stands accused of setting up a shadow government (via task forces that duplicate existing commissions but don’t include enough community representatives), of giving developers too many special favors instead of fighting for more community benefits, and of increasingly siding with conservative and pro-landlord city council member Gordon Wozniak.
The problem is that none of Bates’s opponents look like they would be effective as mayor. So lacking any credible alternative, we’ll go with Bates.
Berkeley City Council, District 1
LINDA MAIO
Incumbent Linda Maio’s voting record has been wimpy at times, but she is a strong proponent of affordable housing, and her sole challenger, Merrilie Mitchell, isn’t a terribly serious candidate. Vote for Maio.

DONA SPRING
A valiant champion of every progressive cause, incumbent Dona Spring is one of the unsung heroes of Berkeley. Using a wheelchair, she puts in the energy equivalent of two or three council members and always remains on the visionary cutting edge. If that weren’t enough, her sole challenger, Latino businessman and zoning commissioner Raudel Wilson, has the endorsement of the Berkeley Chamber of Commerce. Vote for Spring.

KRISS WORTHINGTON
Incumbent Kriss Worthington is an undisputed champion of progressive causes and a courageous voice who isn’t afraid to take criticism in an age of duck and run, including the fallout he’s been experiencing following the closure of Cody’s on Telegraph Avenue, something conservatives have tried to link to his support for the homeless. His sole challenger is the evidently deep-pocketed George Beier, who describes himself as a community volunteer but has the support of landlords and the Berkeley Chamber of Commerce and has managed to blanket District 7 with signage and literature, possibly making his one of the most tree-unfriendly campaigns in Berkeley’s electoral history. Keep Berkeley progressive and vote for Worthington.

JASON OVERMAN
Incumbent Gordon Wozniak postures as if he is going to be mayor one day, and he’s definitely the most conservative member of the council. During his tenure, Wozniak has come up with seven different ways to raise rents on tenants in Berkeley, and he didn’t even vote against Gov. Arnold Schwarzenegger’s special election last year. Challenger Jason Overman may be only 20 years old, but he’s already a seasoned political veteran, having been elected to the Rent Stabilization Board two years ago. Vote for Overman.

ANN-MARIE HOGAN
Ann-Marie Hogan is running unopposed for this nonpartisan post, which is hardly surprising since she’s done a great job so far and has widespread support.

KAREN HEMPHILL, NANCY RIDDLE, NORMA HARRISON
With five candidates in the running and only three seats open, some are suggesting progressives cast only one vote — for Karen Hemphill — to ensure she becomes board president in two years, since the job goes to the person with the most votes in the previous election.
Hemphill has done a great job and has the support of Latino and African American parent groups, so a vote for her is a no-brainer.
So is any vote that helps make sure that incumbents Shirley Issel and David Baggins don’t get reelected.
Nancy Riddle isn’t a hardcore liberal, but she’s a certified public accountant, so she has number-crunching skills in her favor. Our third pick is Norma Harrison, although her superradical talk about capitalism being horrible and schools being like prisons needs to be matched with some concrete and doable suggestions.
Rent Stabilization Board
DAVE BLAKE, HOWARD CHONG, CHRIS KAVANAGH, LISA STEPHENS, PAM WEBSTER
If it weren’t for the nine-member elected Rent Stabilization Board, Berkeley would have long since been taken over by the landlords and the wealthy. This powerful agency has been controlled by progressives most of the time, and this year there are five strong progressives running unopposed for five seats on the board. We recommend voting for all of them.

When we endorsed Aimee Allison in the primary in June, we pointed out that this was a crucial race: incumbent Patrician Kernighan has been a staunch ally of outgoing mayor Jerry Brown and Councilmember Ignacio de La Fuente — and now that Ron Dellums is taking over the Mayor’s Office and a new political era could be dawning in Oakland, it’s crucial that the old prodevelopment types don’t control the council.
Kernighan’s vision of Oakland has always included extensive new commercial and luxury housing development, and like De La Fuente, she’s shown little concern for gentrification and displacement. Allison, a Green Party member, is the kind of progressive who could make a huge difference in Oakland, and she’s our clear and unequivocal choice for this seat.
From crime to city finance, Allison is well-informed and has cogent, practical proposals. She favors community policing and programs to help the 10,000 parolees in Oakland. She wants the city to collect an annual fee from the port, which brings in huge amounts of money and puts very little into the General Fund. She wants to promote environmentally sound development, eviction protections, and a stronger sunshine ordinance. Vote for Allison.

Measure E seeks to eliminate the need to have a citywide special election every time a vacancy occurs on the Rent Stabilization Board, a process that currently costs about $400,000 and consumes huge amounts of time and energy. The proposal would require that vacancies be filled at November general elections instead, since that ballot attracts a wider and more representative group of voters. In the interim, the board would fill its own vacancies.

Measure F follows the council’s October 2005 adoption of amendments that establish the proper use for public and commercial recreation sports facilities, thereby allowing development of the proposed Gilman Street fields. Vote yes.

Measure G is a nice, feel-good advisory measure that expresses Berkeley’s opinion about the dangers of greenhouse gas emissions to the global climate and advises the mayor to work with the community to come up with a plan that would significantly reduce such emissions, with a target of an 80 percent reduction by 2050. IMPEACHMENT OF PRESIDENT GEORGE BUSH AND VICE-PRESIDENT DICK CHENEY

In left-leaning Berkeley this is probably the least controversial measure on the ballot. Do we really need to spell out all over again the many reasons why you should vote yes on this issue?
If this measure passes, both Berkeley and San Francisco will have taken public stands in favor of impeachment, which won’t by itself do much to force Congress to act but will start the national ball rolling. Vote yes.
Measure I
AMENDING CONDO CONVERSION ORDINANCE
NO, NO, NO
Measure I is a really bad idea, one that links the creation of home ownership opportunities to the eviction of families from their homes. It was clearly cooked up by landlord groups that are unhappy with Berkeley’s current condo conversion ordinance, which allows for 100 conversions a year. Measure I proposes increasing that limit to 500 conversions a year, which could translate into more than 1,000 people facing evictions. Those evictions will hit hardest on the most financially vulnerable — seniors, the disabled, low- and moderate-income families, and children. With less than 15 percent of current Berkeley tenants earning enough to purchase their units, this measure decreases the overall supply of rentals, eliminates requirements to disclose seismic conditions to prospective buyers, and violates the city’s stated commitment to fairness, compassion, and economic diversity. Vote no.
Measure J
AMENDING LANDMARK PRESERVATION ORDINANCES
YES
A well-meaning measure that’s opposed by developers, Measure J earns a lukewarm yes. It establishes a nine-member Landmarks Preservation Commission; designates landmarks, structures of merit, and historic districts; and may approve or deny alteration of such historic resources but may not deny their demolition. It’s worth noting that if Proposition 90 passes, the city could face liability for damages if Measure J is found to result in substantial economic loss to property — all of which gives us yet another reason to say “vote no” on the horribly flawed Prop. 90 while you’re voting yes on Measure J.
Oakland Measures
Measure M
POLICE AND FIRE RETIREMENT BOARD INVESTMENTS
YES
Measure M would amend the City Charter to allow the board that oversees the Oakland Police and Fire Retirement System (PFRS) slightly more leeway in making investment decisions. The board claims that its current requirements — which bar investment in stocks that don’t pay dividends — are hampering returns. That’s an issue: between July 2002 and July 2005, the unfunded liability of the PFRS grew from $200 million to $268 million — a liability for which the city of Oakland is responsible. We’re always nervous about giving investment managers the ability to use public money without close oversight, but the new rules would be the same as ones currently in place in San Francisco and Los Angeles.
Measure N
LIBRARY IMPROVEMENT AND EXPANSION BONDS
YES
Oakland wants to improve and expand all library branch facilities, construct a new main library at the Henry J. Kaiser Convention Center, and buy land for and construct two new library facilities in the Laurel and 81st Avenue communities. The upgrades and construction plans come in response to residents’ insistence that they need more space for studying and meeting, increased library programs and services, tutoring and homework assistance for children, increased literacy programs, and greater access to current technology and locations that offer wi-fi.
This $148 million bond would cost only $40 a year for every $100,000 of assessed property. Vote yes.
Measure O
INSTANT RUNOFF VOTING
Ranked-choice voting, or instant runoff voting, is a great concept. The city of Oakland is using it to elect officials in the November election without holding a prior June election. There’s only one problem: so far, Alameda County hasn’t invested in voting equipment that could make implementing this measure possible. Voting yes is a first step in forcing the county’s hand in the right direction. SFBG

The terror of Prop. 90

OPINION San Francisco could see an end to rent control — and minimum-wage requirements and a lot of zoning regulation and environmental protection laws and much more — if Proposition 90 passes this November. We could see an end to limits on condo conversions and an end to requirements that developers build affordable housing units and even an end to limits on the height and density of new developments. That’s because Prop. 90 is a clever trap that purports to restrict the use of eminent domain but in reality eliminates all government regulation of land use.
Prop. 90 really says little about eminent domain; it just uses the notion of restricting the ability of government to seize private land as the bait. Most of the initiative is aimed at ending all government regulation of property. Its concept is simple: if any government regulation reduces the actual or potential value of property — even by a dollar — then the government would have to reimburse the property owner the difference.
For example, if a landlord would be able to get $3,000 a month on the open market for an apartment but rent control limits what a long-term tenant has to pay to $1,500, then the landlord would be able under Prop. 90 to sue San Francisco for the difference. Think about that: about 200,000 rental units in the city are under rent control. Say the average difference between the market rent and the rent-controlled amount is $500 per month. That would mean landlords could collectively sue San Francisco for $200 million each month, or $2.4 billion each year. Since San Francisco obviously can’t afford to put half its annual budget into compensating landlords, there would be no choice but to repeal rent control.
Landlords would also be able to sue for the difference between what their buildings are worth as rental properties and what they are worth as condominiums. Any property owner denied the ability to convert to condominiums could then sue for that difference in value. Since a property subdivided into condos is worth about 50 percent more, this bill would be huge.
The list of disasters goes on and on. If a developer is required to make 15 percent of the units in a housing project affordable, then the developer could sue to make San Francisco pay for the lost income. If zoning laws limit heights in a neighborhood to three stories but a developer wants to build a 10-story condo tower, the developer could sue the city for the lost value of those seven stories of condos.
And it’s not just land-use and tenant protection. The city and the state both have minimum-wage laws; potentially, every business owner could sue to demand compensation for the loss of income that came from mandating higher wages than the market might have allowed. That would be the end of minimum-wage laws. Environmental protection and mitigation could face the same fate.
Prop. 90 is by far the worst measure on this year’s ballot; in fact, it’s the worst measure to come along in quite some time. It’s a plot by right-wingers to gut the ability of government at any level to force businesses and property owners to accept even basic standards of behavior in the name of the public good. The measure hasn’t gotten a whole lot of media attention, but defeating it should be a top priority for every decent Californian. SFBG

Sneak a peak at the California Cereals factory — a gray, boxy concrete sprawl looming over an otherwise peaceful West Oakland neighborhood lined with wood frame houses and a sugary spray of Victorians — and you immediately expect that mulchy aroma of processed wheat products to assault the senses. So why do you detect … barbecuing oysters? But that’s the overriding scent du jour — and the improvisatory, fly-by-the-seat-of-your-fun nature of the Cereal Factory, one of many unpermitted party outposts where the city’s rock, improv, noise, and punk scenes have survived and even thrived in the Bay Area despite fin de siècle real estate insanity, party-killing neighbors, and ticket-threatening cops.
Scruffy, T-shirted kids lounge on the front steps of Jason Smith’s two-story home, dubbed the Cereal Factory for the genuine, sugar-coated article churning out Fruity Pebbles and generic raisin bran across the street. Down a side path, in the small backyard, music scenesters, fans, punks, indie rockers, and cool dudes mingle on the grass and down the canned beer and grillables they’ve brought as CF housemate Daniel Martins of Battleship throws more oysters on the barbie. Double back, and in the basement you find a dark, humid, tiki-embellished crash pad, not uncomfortably crammed with bodies shaking to Italian punk-noise band Dada Swing. Or you catch Bananas, Mika Miko, or Chow Nasty killing the rest of the early evening for gas money.
“My whole thing is to make it free, make it so that people can go to it,” the extremely good-natured Smith says much later. “If there’s a touring band, I always run around with a hat and kind of strong-arm people into coughing up some change or a couple bucks to give them some gas, but otherwise the bands all play here for free. I just provide the coals, and I buy two cases of beer for the bands.” As for the oysters, he adds, “shit like that happens! People are just, like, ‘I caught this huge fish — let’s smoke it.’”
Smith is one of the proud, brave, and reckless few who have turned their homes into unofficial party headquarters, underground live music venues. San Francisco and Oakland are riddled with such weekly, biweekly, and even more sporadic venues — some named and some known by nothing more than an address. But oh, what names: Pubis Noir, 5lowershop, an Undisclosed Location, Club Hot, Noodle Factory, Ptomaine Temple, and the Hazmat House. Some, like the Cereal Factory, are only active during the summer barbecue season; others, like LoBot Gallery, host shows and art exhibits year-round. Why go through the headache of opening your home up to a bunch of hard-partying strangers, music lovers, and the occasional psycho who trashes your bathroom? Some, such as Oakland’s French Fry Factory, have bitten the dust after being busted for allegedly selling beer at shows. Others, such as 40th Street Warehouse and Grandma’s House, have bowed to pressures external (neighbors, landlords) and internal (warehousemates), respectively. Why do we care?
CULTIVATING NEW AND UNDERSERVED SCENES
The Clit Stop can take credit for being one of the first venues in San Francisco to dream up the now-familiar cocktail of noise, indie rock, jazz, and improv. Ex-Crack: We Are Rock and Big Techno Werewolves mastermind Eric Bauer and Bran Pos brain Jake Rodriguez began booking shows in 1998 in Bauer’s 58 Tehama space, once dubbed Gallery Oh Boy. Shows began on time at 8 or 9 p.m. so that East Bay listeners could BART back before midnight, and as a result Bauer and Rodriguez would often open, under assorted monikers. A May 2000 lineup at the Clit Stop (named after Bauer’s band Planet Size: Clit by Caroliner’s Grux) combined scree-kabukists Rubber O Cement with improv rockers Gang Wizard, indies Minmae, and Bauer’s dada-noise Aerobics King; another bill matched the angsty indie-electronica of Casiotone for the Painfully Alone with the noise-guitar-funk of Open City and the jazz sax of Tony Bevan. The common thread? The fact that Bauer and Rodriguez both liked them. “It was kind of hard sometimes,” Bauer says today. “We got requests from tons of shitty bands, and it was, like, ‘No, no, we don’t like you guys.’”
A year after Clit Stop began, Kimo’s started showcasing the same combination of rock and noise characterized by such varied Clit Stop players as Cock ESP, No Neck Blues Band, and Nautical Almanac — a mix that has filtered to the Hemlock Tavern and 21 Grand and into the sounds emerging from Bay Area bands like Deerhoof, Total Shutdown, and the pre–Yellow Swans group Boxleitner, all of whom played the Clit. “The weirder and more fucked up, the better,” Bauer continues. “We wanted to push boundaries — we wanted to annoy people.” Bauer moved out in 2000, leaving Rodriguez to continue to book shows at the venue under, Bauer says, the name Hot Rodney’s Bar and Grill. Bauer went on to put on the first noise-pancake shows with ex–Church Police member and Bauer’s Godwaffle Noise Pancakes co-overlord Bruce Gauld at Pubis Noir, a former sweatshop at 16th Street and Mission. Gauld is expected to put out a DVD of Clit Stop performances this year.
GIVING UNDER-21 KIDS ACCESS TO CHEAP ART
“The cheapness factor is a huge part,” says Cansafis Foote, sax player for the No Doctors. “In Oakland right now, you have a lot of kids who are trying to make a go at being an artist or being a musician or whatever, and almost all of them are broke. But they’re all really excited about people making stuff, so they’ll go to Art Murmurs on the first Friday of the month or they’ll go to warehouse shows, and maybe at the end of the day they won’t have any money in their pocket — and we’re still going to let ’em in to see the show. That, or they’re underage.”
An improv seminar leader at Northwestern University and onetime music teacher in Chicago, Foote was accustomed to instigating music- and merrymaking when he took the lease in February 2005 at Grandma’s House in Oakland. “Everything was kind of funneling out of that experience and just having the background with Freedom From [the label the No Doctors ran with Matthew St. Germain] and free exploratory music.” Grandma’s House had already been putting on shows in the massive warehouse it shared with Limnal Gallery (and at one time the Spazz collective), and Foote threw his energy into doing two to three shows a month — including performances by Sightings, Burmese, Hustler White, Saccharine Trust, and Warhammer 48K — until March, when, he says, an especially loud show by USA Is a Monster brought the police on a noise complaint. Foote, a.k.a. Grandpa, was already bummed because housemates who had initially said they’d help with shows “totally weren’t coming through on that. So I was sitting in my car and watching the gate while everyone was watching the show and I was, like, ‘What’s the point of doing this? I don’t even get to see the show.’ So I took a ladder and put it outside the window. I thought it was fun too, because it was like a clubhouse and people could come up the ladder and through the window into Grandma’s House, and then the cops came, and one told me they’d unlock the seventh door to hell if I did it again.
“I was actually kind of excited — should I allow him to unlock the seventh door to hell for me? Is there going to be a special fire-breathing dragon there for me? It was amazing. It’s, like, ‘Dude, there’s some 16-year-old kid who’s going to shoot some other 16-year-old kid down the street — go deal with him.’”
The next show was the deal breaker: police returned twice to open that door as a brouhaha broke out at a Grey Daturas show between audience members and various warehousemates. Warehouse denizens put pressure on Foote to halt the shows, and now he’s moving out: “It was the only reason I was living there. It’s not real glamorous to be living in a warehouse with little mice and weird bugs in the summer.”
BRINGING ART, THEATER, MUSIC — AND STRAIGHT-EDGED VEGETARIANS TOGETHER
House-party spaces have come and gone, but one of the saddest passings had to be 40th Street Warehouse in Oakland, which put on rock, folk, and hip-hop shows, queer cabaret, and art events from 1996 until the collective shuttered last winter with a last loud musical blowout (This Bike Is a Pipe Bomb headlined) and a commemorative zine. From Monument to Masses guitarist Matthew Solberg lived there for three years and recalls that the onetime auto mechanic shop’s shows were initially started by members of the experimental Noisegate.
By 2003, Solberg says the Temescal space was putting on shows, plays, or benefits every weekend, with an emphasis on rock and metal: Parts and Labor, Tyondai Braxton, High on Fire, Ludicra, Merzbow, Masonna, Melt Banana, a Minor Forest, Lesser, Curtains, Neon Hunk, Hair Police, Deep Dickollective, Thrones, X27, Soophie Nun Squad, Toychestra, 25 Suaves, Monitor Bats, the Intima, Lowdown, the Coachwhips, Hammers of Misfortune, the Vanishing, Mirah, Gravy Train!!!!, Eskapo, and Microphones (last on the Microphones bill, beneath Loch Nest Dumpster, is Devendra Banhart, described as “acoustic ardor from San Francisco’s shyist [sic]”), with bands like Numbers getting a running start with multiple performances there.
The schedule, however, took its toll. “People would move into the warehouse and be really stoked to have that autonomous space, but they didn’t really know what they were getting into. They usually lasted six months, and then they’d be, like, ‘I can’t stand this anymore!’” Solberg says. “But certain people adapted because they were passionate about being able to create that sort of space and making it work: a DIY show space where 100 percent of proceeds went to the bands — and obviously, we’d cover some expenses, like electrical and providing food for the bands. But apart from that, the house didn’t take any money. It was all done out of, I dunno, community service.”
The collective itself got a reputation as a straight-edged vegan cabal that forbade hard drugs and meat in the fridge that sat on the outskirts of the barnlike communal show space. “We didn’t want to succumb to the crash pad–flophouse thing,” Solberg explains. “We just wanted to preserve sanity.”
All that came to an end when in 2004 the Oakland City Council passed the Nuisance Eviction Ordinance, which took aim at crack houses but covered “noise” as a reason for eviction. “The people at 40th Street all believed that was the reason we got so much police attention the last year we were there,” Solberg says. After joining his fellow tenants in a winning fight against their landlord, who had given them a month’s eviction notice in order to convert the space to condos, Solberg moved to Ptomaine Temple, which continues to stage experimental noise shows.
BACK AT THE FACTORY
And despite the rewards, good times, and appreciative bands that get play and earn gas money to their next show, shutdowns are still a threat, casting a shadow even over spots like the Smith-owned Cereal Factory. After a neighbor began objecting last year to the soused kids milling in the street and lined up out the Factory’s front door to go to the bathroom, the Mothballs drummer slowed the shows, built a discreet bathroom in the basement, and then carefully began the music once more. Why bother? The chuckle-prone Smith, who works in the live-music department at KALX, bought the house with the intention of having shows. “At the risk of sounding like a stupid hippie, I think it’s important to contribute things,” he says before the last show of summer 2006 on Sept. 16, with Them There Skies, Sandycoates, and Dreamdate.
This last show likely went off smoothly: the model property owner checked in with his neighbors that evening during his walk home. “I said, ‘Donny, we’re having a barbecue show this Saturday.’ And he said, ‘OK, OK, baby, you’re cool. You’re cool.’ I’m hoping to have everything done by 9 o’clock, and that’s pretty tame on a Saturday night,” Smith explains. It’s guaranteed there won’t be any problem on at least one side of his summer house party — “there’s this Argentinean woman named Pepper and she’s fucking awesome. She’ll be, ‘Aw, yeah, it better be fucking loud because that’s how I know you’re having a good time. You gotta live life!’ SFBG

An explosive issue

Do you know where your natural gas shutoff valve is? Are you going to need a wrench to turn it off? If the ground starts shaking and the ceiling is coming down on your head, are you going to be thinking about your pipes cracking and spewing high-pressure, flammable natural gas into your home?
Probably not, which is why automatic shutoff valves were developed. They trip and kill the gas flow to the pipes inside your house when seismic activity is greater than 5.2 on the Richter scale.
Right now, the city puts its faith in citizens to be ready to kill the gas if the big one hits. Not all cities agree with this policy. After the Northridge earthquake in 1994, Los Angeles passed an ordinance mandating automatic shutoff valves in all new construction and for home repairs greater than $10,000. Alameda, Contra Costa, and Marin counties have similar legislation, as do the cities of Pittsburg and Hercules. Why not earthquake-prone San Francisco?
That’s the question being explored by the city’s Department of Building Inspection (DBI). But there are other questions too: if San Francisco decides to make a policy requiring automatic shutoff valves, can they be installed more expeditiously than the 11 years and counting it has taken Los Angeles?
DBI staff, building inspection commissioners, and city officials from the Fire Department and the Office of Emergency Services held an initial Aug. 30 meeting on the issue, and though it’s too early to tell how San Francisco could mandate installation of these valves, the sentiment was that the status quo strategy of public education is not enough. The discussion also revealed some key questions about where exactly the valves can be installed, who is responsible for them, and who’s going to pay.
In San Francisco there are currently two ways the gas can be shut off when there’s a leak: either Pacific Gas and Electric Co. or the customer can do it. PG&E provides manual shutoff valves at all installations, but they can be difficult to operate, especially for a disabled or senior citizen.
PG&E officials say they don’t have a position when it comes to recommending whether automatic shutoff valves should be installed.
“Because we serve such a large, diverse customer base, our position is a neutral position. We do not support or not support installation of these devices,” PG&E’s Paul Brooks said at the meeting.
Brooks, a senior gas engineer for PG&E, said the company has manual valves for the main gas lines but confirmed that there is nothing in the system that trips automatically during an earthquake. PG&E is responsible for the health of the pipes up to where they meet the meter, after which the customer is liable.
PG&E has been replacing old pipes throughout the city with polyethylene lines, which are designed to flex more before snapping when the ground shakes. In some places, the new pipes allow for gas to be delivered faster, at a much higher pressure. That’s a problem, says Building Inspection Commission president Debra Walker, who’s concerned about the danger of higher-pressured gas being piped into people’s homes.
“We have a unique situation here in the city because of our property lines,” she told the Guardian after the meeting. In San Francisco, it’s common to construct buildings right up to the lot lines, milking every inch of property and making it necessary to put gas meters, gauges, valves, and gas pressure step-downs underneath the structure.
“A lot of these gas lines go into the building before the step-down. The problem and the risk are already in the building,” Walker said. She argues that automatic shutoff valves should be placed farther up the line and PG&E should assume some responsibility for the installation.
Only PG&E could install them. Since 2002, the California Public Utilities Commission (CPUC) has disallowed customers from installing automatic shutoff valves on the gas company’s side of the meter. Fabian Padilla, a former Southern California Gas Company employee who was at the meeting, said utilities lobbied for the prohibition to avoid liability if valves were improperly installed on the gas company’s side.
Brooks cited the CPUC’s general orders when asked whether the company could assume responsibility for installing shutoff valves on their lines and said they would have to be responsible for the valves as well. He didn’t know if that was something the company would be willing to do.
After the meeting, Padilla told us, “It’s obvious that the best way to do it is on the gas company’s side of the meter.” Padilla, who is now president of Affordable Safety Solutions Inc. (ASSI), a company that designs and distributes earthquake gas safety devices and specializes in automatic shutoff valves, thinks company-side installation is easier and more economical because the lines are smaller, the gas doesn’t have to be turned off to install the valves, and in San Francisco’s case, where the meters are under the buildings and difficult to reach, it’s easier to install them elsewhere.
Cost is the other major factor. Padilla said he offers valves and installations for $245 to his Southern California customers. The DBI estimated costs between $250 and $600 per meter, which becomes a pricey endeavor for multiple-dwelling buildings where each unit has its own meter and consequently, its own automatic shutoff valve.
It’s a cost some are concerned that landlords would defer to the tenants. A few hundred dollars for a valve may seem like a worthy investment to most homeowners, and even though your neighbors also benefit when your house doesn’t blow up, not everyone may be willing to throw down for the lifesavers.
The cost to install valves in every household could be enormous, but city officials at the meeting seemed unwilling to issue a mandate without offering some kind of financial assistance. Though it seems unlikely that PG&E would incur the costs as a good-neighbor gesture, the possibility of funding from the city’s office of emergency services or the Federal Emergency Management Agency is being considered. Officials said more research and risk assessment needed to be done, and meetings are being scheduled where the key questions of who pays, where the valves will go, and whether they will be put into widespread use before the big one may get answered.
“It’s very important that we resolve this issue,” Walker said to us after the meeting. “There are challenges around where these valves are and who will be responsible.” SFBG

The attack on public housing

OPINION If the Bush administration has its way, conditions for San Francisco’s public housing residents are about to get much worse.
The San Francisco Housing Authority, which operates 6,000 units of public housing, is facing a $7 million shortfall this year due to Republican-led cuts to the Department of Housing and Urban Development (HUD) budget. Congress has already cut the public housing budget by $1 billion since 2001 and has now created a $300 million shortfall in operating funds for already cash-strapped public housing agencies. As a result, agencies will receive 85.5 percent of what they need. But that’s not all. The president’s proposed budget for 2007 guarantees that funding will drop again to (at most) 80 percent of the need.
San Francisco will be one of the hardest-hit housing authorities. That’s because HUD uses a nonsensical funding formula that unfairly cuts funds to some agencies while providing increased funding for others.
The impact of these budget cuts is alarming, as agencies try to do more with less. Housing authorities across the nation are being forced to cut back vital tenant services such as security and maintenance.
The impact on San Francisco’s public housing residents will be nothing short of disastrous. The housing authority will now have to operate with only $342 per unit (down from $454).
Since Bush took office, per unit funding has declined sharply, from $585 in 1999; combine that with rising housing costs and other expenditures and you’ll see that San Francisco’s poorest have been hit hard. Residents are plagued with deferred maintenance and growing repair needs. Units sit empty because there are no funds for rehab. Shootings continue on many public housing sites while cutbacks in security are made. There’s a backlog of $245 million in immediate capital improvements needs and no plans for new development, despite the 30,000 families who have been languishing for years on the waiting list.
A loss of $7 million will mean dire consequences: longer turnaround on repairs, less secure buildings, and a further halt to modernization and new construction — this at a time when the agency has already failed its tenants and when housing costs continue to climb out of reach of San Francisco’s homeless and low-income families. Congress must take a stand now and stop the Bush administration and its unconscionable attempts to dismantle low-income housing programs. Democrats in Congress should take the lead and demand that a $300 million budget supplemental for public housing be passed to stop the losses for this year. It will also take strong leadership to ensure that public housing is fully funded for 2007. If the Republicans succeed once again in ridding cities of housing for the poor, it would be, as Erni Young of the Philadelphia Daily News wrote, nothing short of “an act of domestic terrorism perpetrated by our own government.” SFBG

SF Opera under the glass

There is no lack of world-class talent in the upcoming fall season, but as far as the portentous tenants in the Civic Center are concerned, the new season’s repertoire stands out as an exercise in artistic tepidness. Perhaps still traumatized by the Bush economy’s brutal impact upon the arts, the San Francisco Opera and Symphony and other big Bay Area arts presenters are taking few chances. Projects with even the subtlest hints of experimentation this season — such as the SF Symphony’s multimedia production of Charlie Chaplin’s City Lights — are being served to the public in carefully marketed packages, brandishing favorite performers with tried-and-true creative teams that have been thoroughly tested over the years.
So as the curtains go up next week, the best performance to watch may well be the one that is taking place offstage: David Gockley, the SF Opera’s new general director, heads his first full season as the top choice for the job. With the company’s somewhat contentious regime change (Pamela Rosenberg vacated the lead post last season), Gockley knows that his every move is being scrutinized by the opera world.
Rosenberg was the only woman leading a major American opera company during her tenure at the SF Opera, boldly introducing on the War Memorial stage the US premieres of major contemporary works such as Olivier Messiaen’s massive St. Francis of Assisi, György Ligeti’s Le Grand Macabre, and the world premiere of John Adams’s Dr. Atomic. Even while facing the funding challenges of a deflated economy, Rosenberg chose to focus the company’s resources on creating the daring, provocative concept-driven productions that are common in Europe. Instead of squandering her production budgets on expensive star singers, Rosenberg brought a fertile artistic sensibility to the company that was wholly fresh and exciting.
Yet the lack of recognizable marquee names combined with the high level of abstraction in her productions displeased the opera’s more conservative, traditional constituencies. Typically, the anti-Rosenberg camp was made up of Metropolitan Opera–jealous patrons and the shrill, mercilessly critical traditionalists who prefer museumlike productions — the kind of stagings populated with ornate period costuming and opulent sets that are often mere vanity vehicles to glorify star singers. So, faced with the criticism of diva-starved patrons and the prospect of having to devote an enormous portion of her time on the job to fundraising, Rosenberg chose not to renew her five-year contract with the SF Opera when it expired.
Attempting to find a less polarizing replacement, the SF Opera’s search committee came up with Gockley, the highly respected former general director of Houston Grand Opera. Chief among Gockley’s strengths is the rapport he has with top talent in the field, paired with a proven ability to entice them into high-profile collaborations.
“I would like to pursue a policy of bringing more of the most prominent stars back to San Francisco, similar to the kind that the public enjoyed during the [Kurt Herbert] Adler and [Terence] McEwen years,” Gockley said in a phone interview last week. “People expect that of a great international company — to provide the big personalities and the most glamorous performers.”
Yes, the divas are back, though certainly not in the abundance suggested by the opera’s tacky marketing campaign launched during the summer season. But what could be the rationale behind the extreme conservatism of SF Opera’s 2006–07 season, in which the most modern entry is Richard Strauss’s Der Rosenkavalier (1911) and the production rosters are populated by stalwart traditionalists such as Michael Yeargan, Thierry Bosquet, and John Conklin? “This year is not mine,” Gockley pointed out, indicating that it was planned by his predecessor before his arrival.
Not unlike Rosenberg, in Houston, Gockley was also known as an innovator and risk taker. In the heart of Bush country, he ushered in Adams’s Nixon in China, a momentous premiere in the history of American opera. A few years later, his controversial commission of Stewart Wallace and Michael Korie’s Harvey Milk was picketed by the religious right.
So what does he have in store for those who actually like more daring theatrical statements?
“Nothing this year,” he said dryly. “But we have already announced a world premiere by Philip Glass [an opera based on the Civil War battle of Appomattox] for next season and will announce the new season in January. Much as I did in Houston, we will have a blend of some core and peripheral repertory work, new works, and premieres — done with great singers and great musical and theatrical values.”
In all fairness, Gockley has the difficult job of being all things to all people during this transitional phase. Of course, this is only the beginning, and before he has the buy-in from all the locals, this former Texan will still have much to prove. SFBG

City Attorney sues major San Francisco landlord

The Mayor’s Office of Communications has for months been fighting with Sup. Chris Daly and several unrelated activists over the release of public documents. By denying and ignoring Sunshine Ordinance requests — including some by the Guardian — the office has garnered a reputation for secrecy that has transformed a disparate group of activists into a united force pushing the boundaries of the city’s landmark open government law.
The Sunshine Ordinance Task Force (SOTF) on July 25 found the MOC in violation of the Sunshine Ordinance on two counts, but the mayor’s spokespeople defied its decision and refused to release seven pages of MOC e-mails that Daly requested. Jennifer Petrucione, who spoke for the mayor at the meeting and left before a final decision had been reached on one of the violations, told the Guardian, “I was contemptuous of the process.”
Her view and that of mayoral press secretary Peter Ragone, as they explained to the Guardian, is that the voluminous nature of some requests and the political motivations of document requesters like Daly violate the spirit of the Sunshine Ordinance, which voters passed in 1993 to encourage public access to how decisions are made in city hall. Instead of disclosing documents, the MOC has found loopholes in the broadly written law permitting them to hide information.
“We have the right to withhold certain documents if they are recommendations,” Petrucione told us July 28, even though the task force generally supports disclosure of such documents. In another case of ignoring a request, she chalked it up to an accident: “That was not us trying to avoid Sunshine, it was us doing it too quickly and overlooking things.”
While both Ragone and Petrucione insisted it’s their policy to release everything they can, even if it’s logistically difficult given the volume of requests they receive, they’re still having a hard time producing documents in a timely fashion. So some activists have reacted to early inaction with ever more voluminous and complicated requests.
The day after we discussed the MOC Sunshine Ordinance policies with Petrucione and Ragone, Mayor Gavin Newsom appeared at a town hall meeting in the Richmond, where we asked him about the dispute with Daly’s office. “I haven’t been privy to the details,” he told us. “I would like to see us readily provide whatever information is being requested. I said, ‘Peter, just send all the information, even in the spirit of the ordinance. We have nothing to hide.’”
Two days later, Petrucione called the Guardian to say the mayor had ordered her office to release the disputed documents after all. She told us, “You guys want to make an issue of it, so we decided to just put them out there.”
BURIED DOCUMENTS
The disputed e-mails requested by Sup. Daly involve Ragone’s purchase last year of a tenancy in common (TIC) from which two disabled residents had been evicted by a landlord evoking the Ellis Act, as first reported by the blog www.beyondchron.org.
Daly was curious if there might be any connection between Ragone’s new digs and Newsom’s vetoes of proposals that would have protected tenants from those kinds of evictions. Daly’s office filed an immediate disclosure request for any documents regarding evictions or condominium conversions.
After the MOC initially responded that they didn’t have any such documents, which Daly’s office didn’t believe, the issue dragged out over four months in front of the SOTF, with the MOC eventually turning over about 25 relevant documents but withholding seven e-mails, with Petrucione citing Section 67.24 of the Sunshine Ordinance: “Only the recommendation of the author may, in such circumstances, be withheld as exempt.”
Daly appeared at the meeting to speak on his own behalf. “I’m not attempting to have a gotcha on the Mayor’s Office. I’m attempting to form a decision,” he said.
The task force doesn’t have the power of subpoena or investigative authority — its members can’t look at the e-mails and decide if they’re public — so the matter was referred to the Ethics Commission, which does. Petrucione, who had the documents at the meeting, could have just handed them to Daly. She told the Guardian, “We’re not concerned about what the e-mails say. We’re trying to adhere to the letter and the spirit of the law.”
In fact, the documents contained only mildly embarrassing information, with a pair of e-mails from Petrucione plotting ways to overshadow the news of Newsom’s tenant protection veto last September by releasing word of the veto late on a Friday and coupling it with a high-profile announcement of San Francisco’s Hurricane Katrina relief efforts, “which will bury any interest in the Ellis release.”
But the MOC’s resistance to disclosure — both to Daly and to activists also seeking information during that same time period — has only served to galvanize those seeking public records.
ACTIVISTS’ SUNRISE
Everyone starts with a little kernel of concern, a reason to wonder or worry about what those elected officials are up to. Kimo Crossman last year wanted to know more about the sketchy municipal wi-fi deal with Google and Earthlink that Newsom was proposing. After hitting initial roadblocks when making requests for specific information like a copy of the contract, Crossman started asking for reams of documents, anything remotely related to the TechConnect plan. His concerns have now expanded to disaster preparedness issues and finally to the Sunshine Ordinance itself.
Last week at the SOTF meeting, where Crossman is now a regular member of the audience, he filed a complaint that the mayor had not provided the opportunity for public comment at a Disaster Council meeting June 5. After reviewing video and transcripts of the meeting and hearing Petrucione’s evolving explanations, the task force found a violation.
Crossman — who at one time was being considered for “vexatious litigant” status by city officials who wanted to tone down his voluminous requests — was pleased and said, “I thought it was a success that the mayor was held accountable to Sunshine just like everyone else in the city.”
Perhaps the violation will inspire the Mayor’s Office to fulfill the outstanding records requests of other citizens, like Wayne Lanier, who had a little home improvement issue.
About a year ago, Lanier and a few of his neighbors repaired the sidewalk around a few trees and planted some flowerpots in front of their homes. Then the city slapped them with a $700 tax, under the Occupancy Assessment Fee for Various Encroachments.
The ordinance was introduced by the mayor and passed the Board of Supervisors in July 2005. It was designed to tax property owners who eat up the public right-of-way with stairways and fences, but the ordinance became what Lanier likes to call the “tree and beauty tax.”
Lanier wanted to know what kinds of meetings and discussions had led up to this ordinance, so in March he sent a Sunshine Ordinance request to Newsom. “I requested his calendar prior to July,” Lanier told the Guardian. “A very simple e-mail request under the Sunshine act.”
Lanier says he has yet to receive an answer to his request, let alone any correspondence or acknowledgement from the Mayor’s Office that they’re working on it. Later, he had concerns about avian flu, where he was again rebuffed in his attempt to get documents.
THE PRICE OF DELAY
The frustrating stories of Crossman and Lanier eventually caught the interest of Christian Holmer, who championed their causes and set out with Crossman on a project they think could streamline the practice of releasing public documents.
Holmer is the secretary of the Panhandle Residents Organization Stanyan Fulton, which has a Web site compendium of all the Sunshine Ordinance requests he knows about. He posts a running countdown of how many days each request has been outstanding, as well as details on the runaround and excuses he receives from city officials.
His goal is to standardize how various departments produce documents and make them more easily accessible to the public “in as few keystrokes as possible,” as he puts it. And to do that, he’s made lots of Sunshine Ordinance requests, which MOC officials argue are too onerous for them to deal with, particularly given Holmer’s lengthy, heavily annotated e-mails, which he fires off to a variety of city departments on a daily basis.
As the many city reps who receive these e-mails will attest, it can take well over an hour to read the entire contents of one e-mail, only to find out it includes enough attachments to keep the reader busy for the better part of a day.
Petrucione and Ragone, who have received Holmer’s request for the mayor’s daily calendar but not yet answered it, cite the difficulty in figuring out exactly what Holmer wants. However, even the Guardian’s simply worded requests for that same information, as well as documents related to the recent health care measure, weren’t filled by the timelines set out by the ordinance.
Ragone says his office is just trying to keep up with the deluge of document requests. He raised the possibility of reforms, such as a designated Sunshine Ordinance officer or standardized form, but the MOC hasn’t formally proposed any.
Matt Dorsey of the City Attorney’s Office is wary of standardizing the system: “I don’t think the law should create a barrier — a ‘you didn’t sign this so I don’t have to answer it’ situation.” SFBG

Why land trusts work

We’ve been watching the community land trust concept for years, and I’ve personally pushed this as a major solution to the housing crisis in the city. And now even the Chronicle is noticing: In a recent Chinatown deal, tenants are able to buy their apartments for just $10,000 — and those units will be affordable forever.

The beauty of a land trust is that it takes housing entirely out of the speculative market. Not to go all Marxist or anything, but it separates the “commodity value” (what you can sell a piece of property for) from the “use value” (the fact that it’s a place to live, not some sort of stock-market index option). Since the private market has been utterly unable to provide affordable housing in San Francisco, and public-sector resources are far too limited to solve the entire problem, land trusts are a great way to keep low-income tenants from losing their homes.

Ever since somebody figured out that movies were, indeed, an art form, directors have been viewed as lone authors, or at least queen bees imperially orchestrating the efforts of mostly faceless subordinate collaborators. This is a flattering view, and sometimes a fairly accurate one. But they don’t call it the film industry — as opposed to, say, the film canvas — for nothing. Most employable directors are worker drones who just get the job done. Any job. After all, it’s competency that’s needed, not vision, the goal being entertainment rather than art.
When Richard Fleischer died three months ago, a final door closed on one of the most versatile, undiscriminating, and thoroughly Hollywood careers ever. In fact, the 90-year-old director had long been retired — his last feature was 1987’s Million Dollar Mystery, a starless farcical flop that coproducer Glad Bags promoted via a product tie-in: a $1 million treasure hunt. (The movie, alas, earned less than its title.) But his never stopped being ubiquitous as the “directed by” name on many of the most frequently televised films ever made. Some had originally been major hits, some bombed, some just punched the clock. But all were created equal in the eyes of the tube — and most likely, it seems, in the purview of Fleischer himself.
Just try connecting the dots between the features Fleischer directed between 1966 and 1976, when he was at his peak as a critically derided but reliable veteran entrusted with millions in studio money. He bounced from the psychedelic sci-fi adventure of Fantastic Voyage — with body-suited Raquel Welch as its most special effect — to 1967’s elephantine family musical fantasy Doctor Dolittle, then wasted no time and probably less sleep before turning to 1968’s The Boston Strangler.
Next up was 1969’s notoriously stupid Che!, with Dr. Zhivago (a.k.a. Omar Sharif) as the romantic revolutionary and daft Jack Palance as Fidel. Then came straight-up WWII patriotism via 1970’s Tora! Tora! Tora!, followed by a western, a Godfather knockoff, Charles Bronson avenging as usual, blind Mia Farrow walking barefoot on broken glass to escape a murderer, 1973’s immortal Soylent Green, 1975’s bad-taste campsterpiece Mandingo, and — perhaps most incredibly in this context — Glenda Jackson as The Incredible Sarah in 1976. (Pauline Kael griped, “To think we were spared Ken Russell’s Sarah Bernhardt only to get Richard Fleischer’s,” dubbing him a “glorified mechanic [who] pleases movie executives because he has no particular interests and no discernable style.”)
Somehow amid all this middlebrow showmanship, Fleischer snuck in a small, low-key, fact-based British movie during 1971. 10 Rillington Place — part of Yerba Buena Center for the Arts’ “Too Scary for DVD: Neglected Horror on 35mm” series — is closer in spirit to the sharp, documentary-influenced B-grade noirs (1952’s The Narrow Margin, 1949’s Trapped) with which he started out his career, before Disney’s 1954 live-action smash 20,000 Leagues under the Sea promoted him to the A-list. Fleischer made several true crime films over the years, but arguably none truer than this chillingly poker-faced tale.
The Christie murders were infamous in Britain, not least because the execution of a probably innocent man played a significant role in that country’s abolition of the death penalty. Milquetoast landlord John Christie drugged, assaulted, and strangled numerous women, hiding their bodies in the Notting Hill house and backyard he shared with tenants and his oblivious wife. 10 Rillington Place focuses on those events of 1948, when a rather awful young couple (Judy Geeson, John Hurt) and their baby took the dingy upstairs flat. The Evanses were easy prey — the husband an illiterate compulsive liar with an IQ of 70, the pretty wife no exemplar either but understandably concerned that a second pregnancy would make their already marginal existence impossible. Christie (Richard Attenborough, future director of Gandhi) claimed knowledge of then-illegal abortion procedures, to Beryl Evans’s fatal misfortune.
Trading in British working-class miserabilism as if born to it (even Ken Loach would be impressed), the distressing yet nonhyperbolic Rillington delivers one credible version of the much-disputed case. Everything about it is astutely controlled, but two performances — Attenborough’s and Hurt’s — push that description into the realm of brilliance, indelibly etching the respective banalities of evil and of innocence.
One might call this sober replay of sordid reality an anomaly for Fleischer, but what film of his isn’t? Like several other major-league commercial directors of the ’60s (Robert Wise, Stanley Donen), he hung on through the ’70s but developed a serious case of irrelevance in the ’80s. Indeed, the embarrassments lined up like ducks: Neil Diamond in The Jazz Singer, Brigitte Nielsen in Red Sonja, Amityville 3-D. No doubt he enjoyed the retirement that by then was so richly deserved. It is reported that he liked playing tiddlywinks with his granddaughter, perhaps while seated near his Mickey Mouse head–shaped swimming pool. (This despite his own father being Betty Boop creator Max Fleischer, Walt Disney’s leading early rival.) The director of Boston Strangler and Mandingo must have been a very nice, normal man to accommodate so many contradictions with so little fuss. He may be in the grave now, but it’s we the living who are spinning. SFBG

A tale of two museums

The Presidio, converted from military to civilian use 12 years ago, has six million square feet of former officers’ quarters, barracks, and buildings that make it unlike any other national park in the country.
This public space has become home to a mixed bag of occupants — primarily private citizens, a smattering of nonprofit organizations, and an increasing number of commercial enterprises — as the Presidio Trust pursues a controversial congressional mandate to be financially self-sustaining.
Two different museums have also vied for residence at the site of the park’s Main Post: the California Indian Museum and Cultural Center (CIMCC) and the Disney Museum. Both submitted viable proposals for exhibition space, representing starkly different futures for the Presidio.
This is the story of how one may get to stay and the other just had to go. This is also the story of how the Presidio Trust is transforming a prized national park into just another piece of real estate to be claimed by the highest bidder.
LOST HERITAGE
In Presidio Trust literature, the Main Post is called the “heart of the Presidio.” The centrally located seven-acre parcel includes an enormous parking lot surrounded by dozens of buildings that provide a steady stream of traffic pumping through the arteries of Presidio Boulevard and Doyle Drive. If you were hoping to attract a regular flow of visitors to your museum, the Main Post would be an ideal place to put it.
Photographs of classic Presidio architecture usually show the northwestern edge of the Main Post where Buildings 103 and 104 are a stately couple among a quintuplet of identical four-story brick structures. They are now empty, except for some temporary office space. Approximately 44,000 square feet each, the historic barracks were built between 1895 and 1897 to accommodate troops returning from frontier battles during the conquest of Native American tribes.
When the National Park Service was handed the Presidio in 1995, the CIMCC became one of the first “park partners” to set up office. For almost two years, the museum negotiated with the park service to lease additional space for the first living museum of Native American culture in California.
The museum planners took a shine to Building 103, paid for a $44,000 renovation study, and kicked off the necessary fundraising with a $2 million allocation from then–Senate president pro tem Bill Lockyer. Joseph Myers, a Pomo Indian, lawyer, and chairman of the CIMCC Board of Directors, said there was a lot of enthusiasm for the project.
“Even when we just had office space here we had international visitors wandering through, wondering when there would be a museum here,” he said.
Things were looking hopeful, and on Sept. 21, 1996, the Presidio, originally home of the Ohlone tribe, hosted a formal dedication of the return of a Native American presence to the park. Then-mayor Willie Brown attended the ceremony and pledged his support to the project.
Not long after, the Presidio’s power structure radically shifted. The park was split into two areas, with Area A along the waterfront managed by the park service and the inland Area B and the bulk of its buildings, including the Main Post, managed by the Presidio Trust — the result of a newfangled proposal by Rep. Nancy Pelosi that won acceptance in a Republican-controlled Congress.
The Presidio is the first national park with a mandate to pay its own way; the trust’s finances are governed by a board of seven presidential designees — initially chaired by downtown-friendly Toby Rosenblatt and including Gap founder Donald Fisher. The new landlords informed the CIMCC that all real estate negotiations were on hold.
“We tried very hard to convince them we would be good tenants,” Myers told the Guardian. “The Presidio is originally one of the places where Indians suffered at the hands of Spanish conquistadors. They were tortured and killed for not being good slaves. That’s old history, but it’s certainly morally and culturally acceptable to consider the Presidio a good place for a museum.”
But over the course of three years, serious discussions with the trust were delayed, and alternate plans and proposals for different buildings were ignored. In September 2000, at Myers’s insistence, the CIMCC finally met with Presidio staff and was encouraged to submit a proposal to renovate three dilapidated buildings near Lombard Gate.
The deadline to submit was short, but the CIMCC met it and museum planners say they were promised a decision within 14 days. Nine months later they received a formal response with, according to Myers, no solid answer. They continued waiting until an article in the San Francisco Chronicle informed them that the buildings had been leased to a private foundation from Silicon Valley.
The results of that deal now stand within sight of the Main Post: the Letterman Digital Arts Center, 850,000 square feet of space renovated and leased for $5.6 million a year by the private company Lucasfilm.
According to Presidio spokesperson Dana Polk, negotiations didn’t work out because the CIMCC couldn’t pay rent or put money into the work on the building. “They weren’t able to do either,” she said.
Somehow the museum was able to do it elsewhere. After withdrawing all proposals and vacating its office space, the CIMCC purchased a 24,000-square-foot building in Santa Rosa. The museum pays $10,000 a month in mortgage for the building, now worth $3 million, and it’s a better deal than the Presidio offered: a leased space at $50,000 a month after $10 million in renovations paid out from the CIMCC’s pocket. But it doesn’t lessen the irony or pain of the situation.
“The philosophy behind keeping the Presidio alive for public access was not for the purpose of George Lucas and Disneyland, but for California culture,” said Myers. “I think they have their own idea of what cultural projects are, and it’s not us.”
The new museum is still under construction in Santa Rosa and will include displays of indigenous art and archives. The National Indian Justice Center already calls it a home, and there are regular workshops on subjects like storytelling and art, current issues, and traditional uses of California native plants.
“That would have been a perfect fit for a national park,” said Joel Ventresca, chair of Preserve the Presidio, a watchdog group that’s fought past Presidio developments. He likened the CIMCC to exhibits in Yosemite where visitors can learn about the lives and legacies of local tribes. “Where is that in the Presidio? It’s nowhere.”
Actually, he’s not quite right. Directly in front of Building 103, there’s an old, paint-chipped sign with faded letters that reads, “Old Burial Ground. The area immediately to the west of this marker was used by the Indians, Spaniards, and Mexicans to bury their dead — 1776–1846. The remains are now in the National Cemetery, Presidio of San Francisco.”
MICKEY MOUSE PROPOSAL
If the CIMCC had found a home in Building 103, Myers would be preparing to welcome a new next-door neighbor. The Disney Museum is the next bastion of culture vying for residence in the Presidio and it has designs on Building 104.
The proposal comes from the nonprofit Disney Family Foundation — a compendium of Walt’s family, headed by daughter Diane Disney Miller, that split from the Disney Company. Due to a curiosity about Walt Disney apparently unsatisfied by several theme parks around the world (one of which, at 47 square miles, is nearly the size of all of San Francisco), the family is looking for a place to display what remains of Disney’s personal artifacts.
Museum planners hope that by 2009 they can invite the public to view items like the Academy Awards he once won and the cars he once drove. Part of the Disney proposal includes renovating Buildings 108 and 122 as well, and the overarching plan is for office space and a reading room, gift shop, and café.
Walt Disney never lived in San Francisco, and when asked why the Disney Family Foundation selected the Presidio, trust spokesperson Polk said of the family, “They live relatively locally, in Napa. They’ve always enjoyed the Presidio and the history here.”
No agreements have been signed yet between Disney and the trust, and according to Polk the project is still subject to approval by the Presidio board. But the foundation has announced the plan on its Web site and held a celebration in November 2004, where Miller and trust staff answered questions about the project.
When the Presidio was first conceived as a national park in 1994, it was sold to the public as a “global center dedicated to the world’s most critical environmental, social, and cultural challenges.” Part of the National Park Service’s General Management Plan was to house people and organizations inspired by their unique setting to do good work for the public benefit. Then when Congress put a financial noose around the park and designed the Presidio Trust with a mandate for fiscal sustainability, that vision was blurred.
“This underlying issue of letting market forces come into play in a national park, it’s a terrible precedent,” said Presidio activist Ventresca. “People who have an important cultural story to tell are given the cold shoulder, and people with deep pockets are being given a place to build a monument to their father.” SFBG

Homes for whom?

“Inclusionary housing program” is a bureaucratic term that seems to invite mental drift. And when the Board of Supervisors’ Land Use Committee considered updating the program’s standards July 12, there was enough mind-numbing economic and regulatory minutiae to sedate the standing-room-only crowd.
But there were also diamonds in that jargony rough. For one thing, San Francisco is now poised to finally force housing developers to spend more of their astronomical profits on housing that sells or rents for far less than the city’s equally obscene housing market dictates. And that’s been made politically possible by an unlikely deal that has downtown developers such as Oz Erickson, affordable housing activists including Calvin Welch, the market-friendly Mayor’s Office of Housing, and progressive Sup. Chris Daly all on the same side.
In the process, a city-commissioned report has lifted the financial veil from big-money housing development in San Francisco, revealing that those who build the biggest high rises require a profit margin of at least 28 percent — or a take-home profit of about $250 million — before they’ll take on a project.
“It used to be illegal [usury to seek such high interest on loaned money], so 28 percent is a sobering number,” Welch said at the hearing.
The public good likely to come from this ordinance — if the current compromise can hold for a few more weeks — is a fairer system for getting people into below-market-rate (BMR) units, policies designed to encourage more housing construction for a wider income mix, and ways to involve more developers and phase in the program so as not to disrupt ongoing projects.
But before we get too deep into the program’s details, let’s take a step back, because the backstory of how we got to this compromise is an intriguing tale with important political implications, particularly for downtown’s current public enemy number one: Chris Daly.
The story really began last summer when the developers of those big new luxury high-rise condos known as One Rincon Hill were trying to get their final approvals. Daly and many of his constituents were concerned that this lucrative project didn’t include enough community benefits or BMR housing.
So the supervisor stepped in and negotiated with the developer a $120 million deal with a huge low-cost-housing element. In the end, the developer agreed to provide affordable units equivalent to about 25 percent of the project.
That’s more than double the city’s current inclusionary housing requirement, which mandates that 12 percent of the units be available below market rate. The requirement rises to 17 percent if the units are built off-site, and developers can pay the city a fee in lieu of doing the actual construction.
The deal got Daly thinking: If the Rincon developers could afford 25 percent, then others probably could too. So he used some of the developer’s money he’d extracted to fund a study looking at how increasing the mandates to 20 and 25 percent would impact housing construction in the city.
Last fall, the Planning Department and Mayor’s Office of Housing assembled a technical advisory committee — made up of cochairs Erickson and Welch and a mix of for-profit and nonprofit developers plus community representatives — to work with the study’s consultants.
Daly put his efforts in the form of an ordinance last October. Sup. Sophie Maxwell also had introduced legislation to strengthen the inclusionary housing program, which has been combined with the Daly legislation. And Sup. Jake McGoldrick last fall introduced legislation to apply the program to buildings of five or more units (it now applies to buildings of 10 units and more), and his ordinance is now being considered along with the Daly-Maxwell legislation.
“This is about housing for everyday people in San Francisco,” Daly said at the July 12 hearing, which was attended by the three supervisors, city staff and consultants, top developers, and a large crowd of housing activists wearing “Housing Justice Now” stickers.
That volatile mix produced a surprising amount of unanimity and compromise (although the Land Use Committee ultimately decided to push the matter back a week to work out some details). Just a few days earlier, when the consultants’ numbers first came in, the measures had seemed headed for an ugly showdown between the progressives and downtown.
The report by Keyser Marston Associates analyzed how much the city can ask for before developers just say no. It was a wake-up call in many respects, showing that San Francisco developers and their financers expect at least 18 percent profit margins for small projects and more than 28 percent for big ones.
For starters, that means that no private developer will build new rental housing in San Francisco, because the profits aren’t high enough. The report also says that developers will avoid putting affordable units in their luxury condo towers; it makes more economic sense to build them off-site or to pay into the city fund instead.
Doug Shoemaker of the Mayor’s Office of Housing (MOH) said his office has learned a lot from the study, particularly about how the in-lieu fee could be adjusted to make BMR housing construction a more attractive option for developers.
“It’s created a bias for developers to just pay the fee,” Shoemaker said, noting that his office increased the in-lieu fee by 15 percent on July 1 and indicating that further increases could be on the way. In fact, one requirement of the ordinance is for the MOH to regularly update fees to reflect evolving market realities.
Yet there was also a potential kiss of death in the report, which ran the numbers and found that developers wouldn’t pursue projects that met the 20 to 25 percent inclusionary housing standard that Daly was seeking.
Daly and his housing activist constituents understood that the report — which was issued just five days before the hearing — would likely translate into a mayoral veto of the legislation, allowing Mayor Gavin Newsom to claim it would hurt the city’s economy and housing needs.
“What we were confronted with last Friday was political death,” Welch said.
So Daly lowered his requirement to 15 and 20 percent respectively and agreed to compromises that grandfather in projects now in the pipeline and ease up the standards on projects that work within their current zoning.
“We do support the compromise,” Matt Franklin of the MOH told the Guardian.
But for Daly the legislation is about more than percentages. For example, it also creates standards for marketing the BMR units to prevent fraud, allows lower-income residents to qualify for them, and requires off-site BMR units to be within one mile of the project.
Daly, a tough former housing activist known for sometimes taking strong and unbending progressive stands, told the Guardian that this deal is consistent with his approach: “Yes, I’ll push the envelope, but that doesn’t mean I won’t take a good deal.”
The July 12 hearing demonstrated that this was a deal being grudgingly accepted by all of the usually polarized sides.
“We, by and large, support this legislation,” Erickson — the Emerald Fund developer and San Francisco Planning and Urban Research Association board member who cochaired the committee — said at the hearing. He also added, “I think it’s doable. I think it’s not going to kill development.”
Yet he also emphasized that the development community is giving all it can: “Fifteen percent was a compromise and we were very reluctant to see it go from 12 to 15 percent.”
Welch also said the compromise was painful for housing activists, who were hoping to get more BMR units out of market-rate housing developers and were astonished at the huge profit margins that are expected by developers and those who finance their projects.
“I think we have been successful at coming up with public policy that meets the needs of developers and low-income residents,” Welch said at the hearing.
Later he told the Guardian that the inclusionary housing update is designed to promote the kind of housing — BMR units for those making just less than the median income — that is also being created by the controversial practice of evicting tenants from apartments and converting those units into condos.
“What this does is help prevent the rental stock from being converted by [tenancies-in-common],” said Welch.
Developer Mike Burke took issue with the criticism of developers at the hearing. “It’s not a guarantee of a 28 percent return. It’s a fair return based on a substantial risk.”
Yet housing activists note that developers already anticipate delays and other financial risks when constructing their financial models, so many developers actually make more than 28 percent on their projects, a fact that the consultant’s report acknowledged.
Eric Quesada of the Mission Anti-Displacement Coalition called on city officials to adopt as tough a standard as possible, using that as a starting point to a broader discussion.
“We need to dig deeper to look at what the goals of San Francisco are for housing,” he said. “This is the ceiling of what we need.” SFBG

Rabid rabbi

“You are my rabbi,” said the caller who claimed to be a Methodist. “Good,” said the talk show host, “Everybody needs a rabbi.”
This is no shock jock being irreverent — he’s a real rabbi. But make no mistake, this is no jolly rebbe kvetching about marrying a nice Jewish boy, nor a lefty Jew talking about justice, diversity, and the Holocaust. He’s Daniel Lapin, dubbed “the show rabbi of the Christian right” by the New York Times. And now he’s a San Francisco talker, Sundays from 1 to 4 p.m. on right-wing radio station KSFO.
But Lapin’s more than a front man. He’s a faith-based political operative who was deeply implicated in the Jack Abramoff scandals when Lapin’s nonprofit, Toward Tradition, was exposed as one of a cluster of tax-exempt organizations through which Abramoff secretly routed tribal Indian and other gambling clients’ funds to an aide to Rep. Tom DeLay in return for favorable legislation.
According to news reports published as recently as last month, Abramoff’s nonprofit money-laundering operations are still under investigation. “It’s not a tax-exempt activity to act as a bagman for Jack Abramoff,” Marcus S. Owens, a tax lawyer and former IRS official, told the Washington Post in June.
The Post piece claims Lapin introduced Abramoff to deposed GOP House leader Tom DeLay, a social feat of epic political proportions. Lapin wrote in a letter to supporters after the scandal broke, “Although I have no clear recollection of having formally introduced them, it is certainly possible.”
Former speaker of the House Newt Gingrich has called Lapin his “spiritual adviser,” and white supremacist David Duke wrote, “There are so few honest voices like that of Rabbi Lapin.”
A rabbi without a congregation, the 59-year-old Lapin gave up his Seattle talk show in February. He’d been filling in for other KSFO hosts and began his show in April, broadcasting from a Seattle studio. Although Lapin denies it, observers opine that he moved to the Bay Area for a fresh start after national publicity about the Abramoff scandals made him radioactive in Seattle.
Toward Tradition has reportedly fallen on hard times after postscandal donations tanked. Lapin has given up his offices, laid off staff, and works out of his home on Mercer Island, a wealthy suburban enclave outside Seattle. He founded Toward Tradition with film critic and neocon radio talker Michael Medved and Abramoff in the early 1990s. The disgraced lobbyist joined the board and served a few terms as chairman. Lapin calls his organization a coalition of Jews and conservative Christians dedicated to faith-based American principles of constitutional and limited government, the rule of law, representative democracy, free markets, a strong military, and a moral public culture.
Until his recent problems, Toward Tradition allowed Lapin to pay himself a $165,000 annual salary, according to a 2003 IRS filing. He also fetched high speaker’s fees and right-wing Christian street cred that’s taken him to the George W. Bush White House for Shabbat dinners and the speaker’s podium at the 1996 Republican National Convention.
Lapin has been a conduit between the GOP and the fundamentalist “values” crowd, but was also directly involved in Republican fundraising. Newsweek reported last year, “When fundraising began for Bush’s re-election effort, Rabbi Daniel Lapin . . . urged friends and colleagues to steer campaign checks to Bush via Abramoff.” For his loyalty, Bush appointed Lapin to the US Commission for the Preservation of America’s Heritage Abroad, which helps protect cemeteries, monuments, and historic buildings in eastern and central Europe. He recently resigned from this post.
Although Lapin can be tedious on the radio, he’s charismatic one-on-one and on the stump. A striking figure in expensive dark suits, bright ties, meticulous ear-to-ear rabbinical beard, and bald pate usually covered with a yarmulke, he is a tall, lanky, ascetic presence.
His mission, as stated on his Web site, is “standing astride America’s secular path to decline, decadence, and depravity.” But his version of Judeo-Christianity looks like a right-wing Republican wish list. Lapin believes that currency and capital markets are revelations granted by God to the Jews and passed on to Christians.
As a man of God, he not only supports stable marriages, family life, faithfulness, and integrity, but (along, he says, with God) favors tax cuts, property rights, sodomy laws, school prayers, school vouchers, arranged marriages, and elimination of government social programs. He opposes promiscuity, abortion, homosexuality, welfare, crime, funding for the arts, gun control, environmental laws, and black people giving their kids “funny” names.
“Recycling,” Lapin told the Guardian, “is the sacred sacrament of secularism.” He told KSFO listeners recently that saying a prayer over your dead pets is sick and bizarre.
According to Lapin’s writings, Terri Schiavo’s death was a “premeditated murder-plot,” and he’s said on the radio that living wills are “suicide notes.” Tattoos, birth control, piercings, abortions, and assisted suicide are all sinful because, as he told the Guardian, it’s not your body, thank you very much, you’re only a tenant. And tenants, in Lapin’s view, have no rights, especially when it comes to moving or evictions.
Lapin also crusades against homosexuality and is a headliner and co-organizer, with virulent Seattle homophobe Rev. Ken Hutcherson, of the effective, antigay Mayday for Marriage rallies, one of which drew some 150,000 supporters to the Mall in Washington, DC, just before the 2004 elections. He makes appearances on the pulpit of Hutcherson’s megachurch near Seattle and they’re jointly involved in other political activities. (Hutcherson is the evangelical who bullied Microsoft in 2005 into withdrawing support for a gay rights bill before the Washington State Legislature, which effectively killed it.)
There was comic relief at hearings last year before the Senate Indian Affairs Committee provided by e-mails between Lapin and Abramoff, and read by North Dakota senator Byron Dorgan. Abramoff asked Lapin to help him sex up a résumé to help him get into Washington’s exclusive Cosmos Club, whose membership includes Nobel Prize winners and establishment elites.
“Most prospective members have received awards and I have received none,” Abramoff complained, going on to say, “It would be even better, if it were possible, that I received these in years past, if you know what I mean.”
Lapin apparently knew what he meant, writing, “Yes, I just need to know what needs to be produced . . . letters? Plaques? Neither?”
Lapin wrote in a letter to supporters that it was merely a “jocular interchange” that he regrets, but Abramoff later used Toward Tradition’s award of “Scholar of Talmudic Studies” in serious applications, according to investigators.
Lapin also leads an organization called the American Alliance of Jews and Christians, which seems to exist only as a page on his Web site. Its board of advisers shows the company he keeps, such far-right luminaries as James Dobson, the current Christian right’s front man; the scandal-tainted Gary Bauer, a failed 2000 presidential candidate; the came-to-Jesus Watergate convict Charles “Tex” Colson; Michael Medved; and preachers Jerry Falwell and Pat Robertson, whose wacky prophecies and laughable gaffes of the last few years have rendered them useless as national spokesmen for the evangelical right. It also includes hard-right orthodox rabbis like Barry Freundel, David Novak, and Meir Soloveichik.
Many Jews are nervous about such lovey-dovey political alliances with the Christian fundamentalists, considering many evangelicals don’t believe God even answers Jewish prayers. To born-agains, Jews will burn in hell if they don’t accept Jesus as their personal savior. Their support of Israel is not born of Christian love, but of Book of Revelation end-world myths that say Jews must control Israel for Christ to come back.
Lapin reassures Jews that despite evangelicals’ having been some of the most persistent anti-Semites in the past, they are the Jews’ natural allies. “I do not fear a Christian America,” he was quoted as saying in an Eastside Weekly article. “I fear a post-Christian America.”
So why does David Duke — the former Ku Klux Klan grand wizard turned Republican congressional candidate — like Lapin? Good question, since Duke’s Christian Identity beliefs hold that Jews are “the children of Satan.” This does not look good on a Judeo-Christian résumé.
In an essay that ran in the Orthodox paper Jewish Press in January, Lapin denounced the silly 2004 movie Meet the Fockers, which starred his old friend Barbra Streisand. He compared its Jewish producers (and such Jews as Howard Stern) with the Jews producing Berlin theater in Weimar Germany, with their “deviant sexuality in all its sordid manifestations.” Lapin quoted Adolf Hitler (the leading voice on “values” of his day) charging that these Jews were responsible for “nine-tenths of all literary filth, artistic trash, and theatrical idiocy.” Apparently, Jews were practically begging to be hauled off to the ovens.
Duke, on his Web site, heartily agreed with Lapin and Hitler, and added that anti-Semitism isn’t just blind hatred, it’s for a darn good reason: “It is revulsion to the actions of the Jewish overseers of our mass media.”
Although he spent time growing up in Britain, Lapin was born and raised in and around white supremacist South Africa in the 1950s. Alongside his Afrikaner accent, it’s easy to detect in Lapin a sense of superiority reflecting the mid-20th-century South African Dutch Reformed Church, whose retributive, racist, and self-righteous worldview justified the apartheid system and provided a sociopolitical framework for his formative years.
Lapin often says non-Judeo-Christian cultures and secular liberalism are more of animals than of God and holds historically contentious theories that Western scientific superiority was developed directly from Judeo-Christianity. “Why didn’t the periodic table surface among the Eskimos?” he asked in a 1996 Eastside Week article. “It doesn’t make sense that Africa hadn’t figured out the wheel by the time England was at the end of the Industrial Revolution.”
The reason, Lapin said in that article, is because they never had the opening lines of the Bible, “In the beginning, God created the heaven and earth.”
And that’s not just for third world heathens — it goes for the rest of us who don’t share the rabbi’s opinions. “Modern American liberalism,” he was quoted as saying, “is unquestionably at odds with everything Judeo-Christianity stands for.”
Strange worldview for a Bay Area audience? Maybe, but not for the station that launched Michael Savage and other angry right-wingers. However, the didactic Lapin has never had real broadcasting success, with short stints at Seattle stations and a stab at national syndication that was short lived. He says he’s doing well in the liberal Bay Area, but time will tell. SFBG

Why is Asa Sullivan dead?

Kahlil Sullivan hasn’t had time to do much lately other than plan for his younger brother’s funeral. He hasn’t even had time to find out exactly why his brother is dead.
“We feel like we’re lost,” he said over the phone a week after his cornered and unarmed brother was shot and killed by the San Francisco Police Department.
The cops have offered two stories as to why officers fired a still-undisclosed number of bullets into the body of Asa Sullivan on June 6. And neither one seems to make much sense or explain why they shot Sullivan.
Meanwhile, the family hasn’t been offered a dime for burial expenses from the Victim Services Division of the District Attorney’s Office. The state won’t spend money to help the families of former felons, but there’s local money available too. That’s off-limits, it turns out, because the SFPD hasn’t classified Sullivan’s death as an “unlawful killing,” according to the DA’s office.
Sullivan’s mother, Kathleen Espinosa, even told us on the day of his funeral, June 15, that the department did not provide a liaison to the family, as the Office of Citizen Complaints two years ago recommended the SFPD do for the families of officer-involved shooting victims.
In fact, Espinosa hasn’t heard a word from the department. Everything she knows has come largely from two stories in the San Francisco Chronicle.
Espinosa, a short, relentlessly cheerful woman with chestnut hair, held a smile throughout her son’s funeral while hugging Sullivan’s tearful young friends. She said any new information from the department right now hardly matters.
“Let them get their story straight first before they come to me,” she said. “I don’t want another wrong story.”
According to early reports, Sullivan and his friend, 25-year-old Jason Martin, were staying with two tenants at a Villas Parkmerced townhouse, part of a 3,200-unit complex close to the San Francisco State University campus. Sullivan had been in some trouble in the past; his criminal record included an armed robbery, and he was on probation for selling pot. But he’d secured a job at Goodwill and had a six-year-old son to look after.
Martin and Sullivan were helping to clean up the townhouse so their friends could receive their security deposit when they moved out. The tenants were being evicted for not paying rent, but a Parkmerced official told the media that the tenants were still legally living there.
The cops said a neighbor called the police, believing the unit had been taken over by nonresidents. Police Chief Heather Fong insisted in press statements that the complex was having problems with squatters. But Parkmerced public policy director Bert Polacci told the Guardian that the complex had no such problems. If the cops had called him, he might have cleared up the residency status of the occupants of 2 Garces Drive.
When Officers Michelle Alvis and John Keesor arrived, they immediately detained Martin, in response to the neighbor’s complaint. Sullivan, who feared going to jail for a probation violation, fled to a two-and-a-half-foot-high attic space.
The officers attempted to talk him down with Martin’s help but eventually went into the attic. Martin later insisted, according to Espinosa, that he told the officers Sullivan was unarmed before they went after him.
The way the cops tell it, Sullivan — who would have been unable to stand up in the tiny space — took a combative stance from inside the attic, and the officers believed he had aimed a gun at them.
The department first reported that Sullivan had shot at the officers through the attic floor. Further, the cops reported that Sullivan’s gun was found at the scene. The truth is, all they found was the case to a pair of eyeglasses.
SFPD spokesperson Neville Gittens told us only that the first story was based on “secondhand information” and “witness statements.”
The official story changed several hours after the department offered its first explanation of what happened. According to Gittens, Keesor fired first, and a ricochet nicked his partner’s ear, “perhaps” causing her to fire as well. When the smoke cleared, Sullivan was dead. No gun was ever found.
“They got flashlights,” Sullivan’s brother Kahlil exclaimed. “Can’t they see his hands? Why didn’t they ask him questions first? We may never know the truth.”
One of the two officers had their flashlights on, Gittens said, but he couldn’t confirm whether the illumination was enough to identify exactly what was in Sullivan’s hand. Gittens told the Guardian that Fong has not yet made a decision about whether to return the officers to regular duty.
Gittens initially refused on June 9 to release the names of the officers involved to the Guardian, but the day after we asked for them, they appeared in the Chronicle. And the department has not yet responded to a Guardian request for documents associated with the shooting.
In 2004, the police commission voted unanimously to conditionally require the disclosure of incident reports to the families of officer-involved shooting victims as swiftly as possible. That change, and the request that the SFPD provide a liaison to the family, were inspired by the death of Cammerin Boyd, who was shot and killed in the spring of 2004 by SFPD officers following a car chase.
But during several subsequent commission meetings, the recommendations disappeared into the ether. And it’s not the first time that proposed reforms were simply ignored by the SFPD, a fact commission vice president Theresa Sparks readily admits.
“I was a little surprised the chief released the names as fast as she did,” Sparks told us.
Sparks nonetheless said that she is still troubled by the so-far inconsistent stories the department has offered to the public and the commission.
“The first story that came out was totally incorrect, [and] the chief could not tell us why the story changed,” Sparks said. “It’s criminal that these families sit there with no specific knowledge about what happened.”
Sullivan’s funeral was attended by his siblings — Kahlil, brother Sangh, and sisters T-sha Sullivan and Tasha Mosby-Greer — and a capacity crowd of Asa’s friends and other family, all in Duggan’s Funeral Home, right across from the Mission Police Station.
Born on Sept. 8, 1980, Asa grew up in San Francisco and attended Bay Area schools. Friends remembered his playful sense of humor. For a time recently, he stayed with his mom while working at Goodwill, commuting from San Jose at 5 a.m. and returning late.
“He made everybody laugh,” Espinosa said. “He didn’t deserve to be cornered in an attic and gunned down.”
The family has contacted Oakland civil rights attorney John Burris, who told the Guardian that during his handling of hundreds of officer-misconduct cases, he’s seen families victimized by police denied documents, explanations, and the truth.
“If there’s one thing I’ve found, it’s police agencies do a disservice to the victim’s family when they don’t provide information,” Burris said. “When the families ask questions, they don’t respond.” SFBG

Legislation that would ban landlords from arbitrarily eliminating services or restricting access to common space in residential units is likely to get seven votes at the Board of Supervisors June 6th. It’s also likely to get a mayoral veto. So tenant advocates ought to be putting the pressure on Sup. Bevan Dufty, who is one of the mayor’s allies – but is also in a district where a majority of the voters are renters.

 

The bill, by Sup. Ross Mirkarimi, would end what some tenants say is a growing practice: Landlords suddenly take away parking spaces, access to laundry facilities, or the use of storage space, in the hope that it will drive out tenants who are protected by rent control. The current law forbids evictions without “just cause” – but that provision apparently doesn’t apply to anything other than the actual place where a tenant lives.

 

There are all sorts of opportunities for abuse here: A landlord could evict a tenant from his or her parking or storage space, then offer to rent it back at a high price. Or those sorts of amenities could be doled out to tenants who never complain about living conditions, and withheld from tenants who try to exercise their rights. Or – most likely – a landlord desperate to get rid of a tenants who is paying below-market rent could take away every possible amenity until that tenant gives up and moves away, allowing the landlord to raise the rent for the next tenant.

 

The fix is simple, and won’t cost landlords any extra money. Mirarimi’s bill is just basic fairness: If you offer a garage as part of the original rental deal, you can’t suddenly take it back without a valid reason. If you include on-site laundry facilities as part of the lease, you can’t arbitrarily lock the door to the laundry room and give only certain favored tenants a key.

 

Dufty is up for re-election this fall, and is almost certain to face some serious opposition from the left. With three of the mayor’s four allies – Sean Ellsernd, Michela Alioto-Pier and Finoa Ma – pretty much immovable, Dufty’s been in a position to make or break legislation by being the eighth vote to make a bill veto-proof. And since Newsom has vetoed every significant piece of tenant legislation to come before him, Dufty needs to feel the heat: Is he on the side of tenants – when it matters?

 

This one is a great test case: The legislation is so simple and fair, it’s hard to imagine how a reasonable landlord could oppose it. Let’s see if Dufty’s willing to stand with the tenants on one that ought to be a no-brainer. Give him a call, at 554-6968.

 

Newsom loses control

In the early days, the mayor tried to sound like a practical, hands-on executive who was ready to run San Francisco.

Mayor Gavin Newsom used his inaugural address on Jan. 8, 2004, to emphasize that he was a uniter, not a divider and that he wanted to get things done.

"I say it’s time to start working together to find common purpose and common ground," he proclaimed. "Because I want to make this administration about solutions."

It’s a mantra he’s returned to again and again in his rhetoric on a wide range of issues, claiming a "commonsense" approach while casting "ideology" as an evil to be overcome and as the main motive driving the left-leaning majority of the San Francisco Board of Supervisors.

"Because it’s easy to be against something," Newsom said on that sunny winter day. "It’s easy to blame. It’s easy to stop…. What’s hard is to hear that maybe to come together, we need to leave behind old ideas and long-held grudges. But that’s exactly what we need to do."

But if that’s the standard, Newsom has spent the past 17 months taking the easy way.

It’s been a marked change from his first-year lovefest, when he tried to legalize same-sex marriage, reach out to BayviewHunters Point residents, and force big hotels to end their lockout of workers.

A Guardian review of the most significant City Hall initiatives during 2005 and 2006 as well as interviews with more than a dozen policy experts and public interest advocates shows that Newsom has been an obstructionist who has proposed few "solutions" to the city’s problems, and followed through on even fewer.

The Board of Supervisors, in sharp contrast, has been taking the policy lead. The majority on the district-elected board in the past year has moved a generally progressive agenda designed to preserve rental units, prevent evictions, strengthen development standards, promote car-free spaces, increase affordable housing, maintain social services, and protect city workers.

Yet many of those efforts have been blocked or significantly weakened by Newsom and his closest allies on the board: Fiona Ma, Sean Elsbernd, Michela Alioto-Pier, and Bevan Dufty. And on efforts to get tough with big business or prevent Muni service cuts and fare hikes, Newsom was able to peel off enough moderate supervisors to stop the progressives led by Chris Daly, Tom Ammiano, and Ross Mirkarimi at the board level.

But one thing that Newsom has proved himself unable to do in the past year is prevent progressive leaders particularly Daly, against whom Newsom has a "long-held grudge" that has on a few recent occasions led to unsavory political tactics and alliances from setting the public agenda for the city.

Balance of power

The Mayor’s Office and the Board of Supervisors are the two poles of power at City Hall and generally the system gives a strong advantage to the mayor, who has far more resources at his disposal, a higher media profile, and the ability to act swiftly and decisively.

Yet over the past year, the three most progressive supervisors along with their liberal-to-moderate colleagues Gerardo Sandoval, Jake McGoldrick, Aaron Peskin, and Sophie Maxwell have initiated the most significant new city policies, dealing with housing, poverty, health care, alternative transportation, violence prevention, and campaign finance reform.

Most political observers and City Hall insiders mark the moment when the board majority took control of the city agenda as last summer, a point when Newsom’s honeymoon ended, progressives filled the leadership void on growth issues, problems like tenants evictions and the murder rate peaked, and Newsom was increasingly giving signs that he wasn’t focused on running the city.

"Gay marriage gave the mayor his edge and gave him cover for a long time," said Tommi Avicolli Mecca, a queer and tenants rights activist. "About a year ago that started to wear off, and his armor started to be shed."

Daly was the one supervisor who had been aggressively criticizing Newsom during that honeymoon period. To some, Daly seemed isolated and easy to dismiss at least until August 2005, when Daly negotiated a high-profile deal with the developers of the Rincon Hill towers that extracted more low-income housing and community-benefits money than the city had ever seen from a commercial project.

The Newsom administration watched the negotiations from the sidelines. The mayor signed off on the deal, but within a couple months turned into a critic and said he regretted supporting it. Even downtown stalwarts like the public policy think tank San Francisco Planning and Urban Research Association noted the shift in power.

"I think we saw a different cut on the issue than we’ve seen before," SPUR executive director Gabriel Metcalf told us. "Chris Daly is not a NIMBY. I see Chris Daly as one of the supervisors most able to deal with physical change, and he’s not afraid of urbanism…. And he’s been granted by the rest of the board a lot of leadership in the area of land use."

SPUR and Metcalf were critical of aspects of the Daly deal, such as where the money would go. But after the deal, Newsom and his minions, like press secretary Peter Ragone, had a harder time demonizing Daly and the board (although they never stopped trying).

Around that same time, hundreds of evictions were galvanizing the community of renters which makes up around two-thirds of city residents. Newsom tried to find some compromise on the issue, joining Peskin to convene a task force composed of tenants activists, developers, and real estate professionals, hoping that the group could find a way to prevent evictions while expanding home ownership opportunities.

"The mayor views the striking of balance between competing interests as an important approach to governing," Ragone told the Guardian after we explained the array of policy disputes this story would cover.

The task force predictably fell apart after six meetings. "The mayor was trying to find a comfortable way to get out of the issue," said Mecca, a member of the task force. But with some issues, there simply is no comfortable solution; someone’s going to be unhappy with the outcome. "When that failed," Mecca said, "there was nowhere for him to go anymore."

The San Francisco Tenants Union and its allies decided it was time to push legislation that would protect tenants, organizing an effective campaign that finally forced Newsom into a reactionary mode. The mayor wound up siding overtly with downtown interests for the first time in his mayoral tenure and in the process, he solidified the progressive board majority.

Housing quickly became the issue that defines differences between Newsom and the board.

Free-market policy

"The Newsom agenda has been one of gentrification," said San Francisco Tenants Union director Ted Gullicksen. The mayor and his board allies have actively opposed placing limitations on the high number of evictions (at least until the most recent condo conversion measure, which Dufty and Newsom supported, a victory tenants activists attribute to their organizing efforts), while at the same time encouraging development patterns that "bring in more high-end condominiums and saturate the market with that," Gullicksen explained.

He pointed out that those two approaches coalesce into a doubly damaging policy on the issue of converting apartments into condominiums, which usually displace low-income San Franciscans, turn an affordable rental unit into an expensive condominium, and fill the spot with a higher-income owner.

"So you really get a two-on-one transformation of the city," Gullicksen said.

Newsom’s allies don’t agree, noting that in a city where renters outnumber homeowners two to one, some loss of rental housing is acceptable. "Rather than achieve their stated goals of protecting tenants, the real result is a barrier to home ownership," Elsbernd told us, explaining his vote against all four recent tenant-protection measures.

On the development front, Gullicksen said Newsom has actively pushed policies to develop housing that’s unaffordable to most San Franciscans as he did with his failed Workforce Housing Initiative and some of his area plans while maintaining an overabundance of faith in free-market forces.

"He’s very much let the market have what the market wants, which is high-end luxury housing," Gullicksen said.

As a result, Mecca said, "I think we in the tenant movement have been effective at making TICs a class issue."

Affordable housing activists say there is a marked difference between Newsom and the board majority on housing.

"The Board of Supervisors is engaged in an active pursuit of land-use policy that attempts to preserve as much affordable housing, as much rental housing, as much neighborhood-serving businesses as possible," longtime housing activist Calvin Welch told us. "And the mayor is totally and completely lining up with downtown business interests."

Welch said Newsom has shown where he stands in the appointments he makes such as that of Republican planning commissioner Michael Antonini, and his nomination of Ted Dienstfrey to run Treasure Island, which the Rules Committee recently rejected and by the policies he supports.

Welch called Daly’s Rincon deal "precedent setting and significant." It was so significant that downtown noticed and started pushing back.

Backlash

Board power really coalesced last fall. In addition to the housing and tenant issues, Ammiano brought forward a plan that would force businesses to pay for health insurance plans for their employees. That galvanized downtown and forced Newsom to finally make good on his promise to offer his own plan to deal with the uninsured but the mayor offered only broad policy goals, and the plan itself is still being developed.

It was in this climate that many of Newsom’s big-business supporters, including Don Fisher the Republican founder of the Gap who regularly bankrolls conservative political causes in San Francisco demanded and received a meeting with Newsom. The December sit-down was attended by a who’s who of downtown developers and power brokers.

"That was a result of them losing their ass on Rincon Hill," Welch said of the meeting.

The upshot according to public records and Guardian interviews with attendees was that Newsom agreed to oppose an ordinance designed to limit how much parking could be built along with the 10,000 housing units slated for downtown. The mayor instead would support a developer-written alternative carried by Alioto-Pier.

The measure downtown opposed was originally sponsored by Daly before being taken over by Peskin. It had the strong support of Newsom’s own planning director, Dean Macris, and was approved by the Planning Commission on a 61 vote (only Newsom’s Republican appointee, Antonini, was opposed).

The process that led to the board’s 74 approval of the measure was politically crass and embarrassing for the Mayor’s Office (see “Joining the Battle,” 2/8/06), but he kept his promise and vetoed the measure. The votes of his four allies were enough to sustain the veto.

Newsom tried to save face in the ugly saga by pledging to support a nearly identical version of the measure, but with just a couple more giveaways to developers: allowing them to build more parking garages and permitting more driveways with their projects.

Political observers say the incident weakened Newsom instead of strengthening him.

"They can’t orchestrate a move. They are only acting by vetoes, and you can’t run the city by vetoes," Welch said. "He never puts anything on the line, and that’s why the board has become so emboldened."

Rippling out

The Newsom administration doesn’t seem to grasp how housing issues or symbolic issues like creating car-free spaces or being wary of land schemes like the BayviewHunters Point redevelopment plan shape perceptions of other issues. As Welch said, "All politics in San Francisco center around land use."

N’Tanya Lee, executive director of Coleman Advocates for Children and Youth, said the Newsom administration has done a very good job of maintaining budgetary support for programs dealing with children, youth, and their families. But advocates have relied on the leadership of progressive supervisors like Daly to push affordable housing initiatives like the $20 million budget supplemental the board initiated and approved in April.

"Our primary concern is that low- and moderate-income families are being pushed out of San Francisco," Lee told us. "We’re redefining what it means to be pro-kid and pro-family in San Francisco."

Indeed, that’s a very different approach from the so-called pro-family agenda being pushed by SFSOS and some of Newsom’s other conservative allies, who argue that keeping taxes low while keeping the streets and parks safe and clean is what families really want. But Lee worries more about ensuring that families have reasonably priced shelter.

So she and other affordable housing advocates will be watching closely this summer as the board and Newsom deal with Daly’s proposal to substantially increase the percentage of affordable housing developers must build under the city’s inclusionary-housing policy. Newsom’s downtown allies are expected to strongly oppose the plan.

Even on Newsom’s signature issue, the board has made inroads.

"In general, on the homeless issue, the supervisor who has shown the most strong and consistent leadership has been Chris Daly," said Coalition on Homelessness director Juan Prada.

Prada credits the mayor with focusing attention on the homeless issue, although he is critical of the ongoing harassment of the homeless by the Police Department and the so-called Homeward Bound program that gives homeless people one-way bus tickets out of town.

"This administration has a genuine interest in homeless issues, which the previous one didn’t have, but they’re banking too much on the Care Not Cash approach," Prada said.

Other Newsom initiatives to satisfy his downtown base of support have also fallen flat.

Robert Haaland of the city employee labor union SEIU Local 790 said Newsom has tried to reform the civil service system and privatize some city services, but has been stopped by labor and the board.

"They were trying to push a privatization agenda, and we pushed back," Haaland said, noting that Supervisor Ma’s alliance with Newsom on that issue was the reason SEIU 790 endorsed Janet Reilly over Ma in the District 12 Assembly race.

The turning point on the issue came last year, when the Newsom administration sought to privatize the security guards at the Asian Art Museum as a cost-saving measure. The effort was soundly defeated in the board’s Budget Committee.

"That was a key vote, and they lost, so I don’t think they’ll be coming back with that again," Haaland said, noting that labor has managed to win over Dufty, giving the board a veto-proof majority on privatization issues.

Who’s in charge?

Even many Newsom allies will privately grumble that Newsom isn’t engaged enough with the day-to-day politics of the city. Again and again, Newsom has seemed content to watch from the sidelines, as he did with Supervisor Mirkarimi’s proposal to create a public financing program for mayoral candidates.

"The board was out front on that, while the mayor stayed out of it until the very end," said Steven Hill, of the Center for Voting and Democracy, who was involved with the measure. And when the administration finally did weigh in, after the board had approved the plan on a veto-proof 92 vote, Newsom said the measure didn’t go far enough. He called for public financing for all citywide offices but never followed up with an actual proposal.

The same has been true on police reform and violence prevention measures. Newsom promised to create a task force to look into police misconduct, to hold a blue-ribbon summit on violence prevention, and to implement a community policing system with grassroots input and none of that has come to pass.

Then, when Daly took the lead in creating a community-based task force to develop violence prevention programs with an allocation of $10 million a year for three years Measure A on the June ballot Newsom and his board allies opposed the effort, arguing the money would be better spent on more cops (see “Ballot-Box Alliance,” page 19).

"He’s had bad counsel on this issue of violence all the way through," said Sharen Hewitt, who runs the Community Leadership Academy Emergency Response project. "He has not done damn near enough from his position, and neither has the board."

Hewitt worries that current city policies, particularly on housing, are leading to class polarization that could make the problems of violence worse. And while Newsom’s political allies tend to widen the class divide, she can’t bring herself to condemn the mayor: "I think he’s a nice guy and a lot smarter than people have given him credit for."

Tom Radulovich, who sits on the BART board and serves as executive director of Transportation for a Livable City (which is in the process of changing its name to Livable City), said Newsom generally hasn’t put much action behind his rhetorical support for the environment and transit-first policies.

"Everyone says they’re pro-environment," he said.

In particular, Radulovich was frustrated by Newsom’s vetoes of the downtown parking and Healthy Saturdays measures and two renter-protection measures. The four measures indicated very different agendas pursued by Newsom and the board majority.

In general, Radulovich often finds his smart-growth priorities opposed by Newsom’s allies. "The moneyed interests usually line up against livable city, good planning policies," he said. On the board, Radulovich said it’s no surprise that the three supervisors from the wealthiest parts of town Ma, Elsbernd, and Alioto-Pier generally vote against initiatives he supports.

"Dufty is the oddity because he represents a pretty progressive, urbane district," Radulovich said, "but he tends to vote like he’s from a more conservative district."

What’s next?

The recent lawsuit by the San Francisco Chamber of Commerce and the Committee of Jobs urging more aggressive use of a voter-approved requirement that board legislation undergo a detailed economic analysis shows that downtown is spoiling for a fight (see “Downtown’s ‘Hail Mary’ Lawsuit,” page 9). So politics in City Hall is likely to heat up.

"There is a real absence of vision and leadership in the city right now, particularly on the question of who will be able to afford to live in San Francisco 20 years from now," Mirkarimi said. "There is a disparity between Newsom hitting the right notes in what the press and public want to hear and between the policy considerations that will put those positions into effect."

But Newsom’s allies say they plan to stand firm against the ongoing effort by progressives to set the agenda.

"I think I am voting my constituency," Elsbernd said. "I’m voting District Seven and voicing a perspective of a large part of the city that the progressive majority doesn’t represent."

Newsom flack Ragone doesn’t accept most of the narratives that are laid out by activists, from last year’s flip in the balance of power to the influence of downtown and Newsom’s wealthy benefactors on his decision to veto four measures this year.

"Governing a city like San Francisco is complex. There are many areas of nuance in governing this city," Ragone said. "Everyone knows Gavin Newsom defies traditional labels. That’s not part of a broad political strategy, but just how he governs."

Yet the majority of the board seems unafraid to declare where they stand on the most divisive issues facing the city.

"The board has really, since the 2000 election has been pushing a progressive set of policies as it related to housing, just-taxation policies, and an array of social service provisions," Peskin said. "All come with some level of controversy, because none are free." SFBG

Eviction battle continues

Back when the tsunami of condo conversions now rolling across San Francisco was but a ripple on the rental pool, local resident William Johnston didn’t know "the ins and outs of the Ellis Act."

"Now I have a Ph.D. in it," jokes Johnston, 70, about the legislation allowing landlords to get out of the rental market, which has been increasingly abused over the past decade by landlords wishing to sell their buildings in a scheme known as tenancy-in-common.

Under the TIC system, tenants share the same mortgage but live in their own unit, which they usually hope to convert to an individually owned condo. And it was a letter proposing a TIC in the 10-unit rent-controlled building where Johnston has lived for 33 years that finally got the feisty septuagenarian to start learning about the Ellis Act in detail.

"That letter scared the crap out of me," says Johnston, who was shocked when a real estate agent claimed that the one-bedroom unit, for which Johnston pays $512 a month, would fetch half a million dollars if it were converted into a condo … if only Johnston could pony up $90,000 for a down payment.

Johnston was relieved when none of his fellow tenants took his landlord’s TIC bait, but they’re all worried the landlord plans to put the building up for sale anyway. So he’s closely following the latest chapter in the Board of Supervisors’ effort to protect renters like him.

On May 9 the board gave an initial 73 approval to a measure that would prevent condo conversions in buildings where seniors, the disabled, the catastrophically ill, or multiple tenants have been evicted.

Three previous board efforts to help tenants have been vetoed by Mayor Gavin Newsom, so Sup. Aaron Peskin heeded input from the Mayor’s Office and amended the measure to move the cutoff date for considering evictions from Jan. 1, 1999, to May 1, 2005.

That change, and the fact that he’d been getting public pressure from renters, apparently won the support of Sup. Bevan Dufty, who had voted to uphold Newsom’s vetoes of the previous renter measures. But with Sup. Ross Mirkarimi forced to abstain because he owns a TIC, the board is still left one vote shy of being able to override a veto.

The date change could affect renters like Debra Hutzer, who is disabled by thyroid problems and whose eviction papers were filed January 2005, forcing her to move on May 13, 2006, from the rent-controlled apartment on Church Street where she’s lived for 19 years to a place where she’s already paying $250 more a month.

"It’s been very disconcerting," says Hutzer of the eviction, which one of her neighbors, Carole Fanning, may now fight. Fanning is also supposed to leave, but she’s now hired an attorney to fight for "a stay of execution" that would allow her to remain in her rent-controlled unit.

"It’s possible, since seniors, disabled, and the catastrophically ill have one year from the date their eviction notice was served, that some may yet be able to convince landlords not to proceed," Peskin board aide David Owen told us.

As for the watering down of Peskin’s original measure, Ted Gullicksen of the San Francisco Tenants Union says the alternative was to put a version backdated to November 2004 on the November ballot a strategy that would have involved taking risks on an initiative that, even if it had passed, wouldn’t have gone into law until January 2007.

"Instead we have a measure that’s acceptable and has passed its first reading, which means tenants should be protected in another week," Gullicksen says. Peskin’s other amendment allows buildings with multiple evictions but not those involving the elderly or disabled to be eligible for condo conversions after 10 years. "This means those buildings get taken off the speculative real estate market," Gullicksen adds. SFBG
